Document Review Decision No. 2024018809 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty a.m. on July 5, 2024.

Amparo proceeding (recurso de amparo) filed by [Nombre62 001], [Valor 001], [Nombre62 002], [Valor 002], [Nombre62 003], [Valor 003], [Nombre62 004], [Valor 004], [Nombre62 005], [Valor 005], against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS AND THE MUNICIPALIDAD DE PARAÍSO.

Findings of Fact:

  1. 1In a brief received by the Chamber’s Secretariat on April 24, 2024, the petitioners filed an amparo proceeding and stated that they own and reside on land located at Dirección7399, in Peñas Blancas de Cachí. They allege that this area has never had a municipal drinking-water service, nor has it received a water supply from ICAA or any ASADA (none has been established to date to manage the area’s wells and water sources or springs (nacientes)). Accordingly, they state that, to meet their need for water, a smaller group obtained authorization from Mr. Nombre01 more than 20 years ago to use the spring located on his property. For reasons unknown to them, they emphasize that around 2014 and 2015 the flow of water was interrupted for several months, forcing the residents to collect rainwater to meet their household needs and those of their animals and crops. As a result of that situation, [Nombre62 005] requested drinking-water service from the Municipalidad de Paraíso for the first time.The request was denied on the ground, as stated in official letter 2015-09-09 MUPAACUE-1234-2015, that no drinking-water pipeline belonging to the Municipalidad’s supply system was located near the property. They argue that at the beginning of 2016, given the impossibility of obtaining water through the responsible institutions, the petitioner and another resident sought out Mr. Nombre01, who was accompanied by his son Nombre67104, whom he introduced as the owner of the property where the spring was located. From that time onward, Mr. Nombre67104 authorized them to draw water from the site to supply their properties. They argue that: “For those purposes, and brought together by necessity, we formed a group that has existed ever since, for the purpose of making the investments needed to purchase, install, and maintain the hoses and valves that carry water from the spring to our properties.Although informal, the group meets periodically and remains in constant contact. It should be emphasized that the spring is located deep in the mountains and that we must cross three different properties to collect and convey the water, without having experienced any difficulty accessing the water source until February of this year. Five years after the first request, in October 2021, we requested water service for a second time from the then head of the municipal waterworks, Mr. Juan Carlos Porras Pizarro, explaining that although the way we were obtaining water partially met our need for the resource, it was risky because, as stated in the preceding paragraph, we depended on the owners of three different properties for the water to reach our properties, and we had nothing more than oral agreements with them, which could change if any or all of them changed their willingness to cooperate.” However, it was not until March 2022 that they were informed that the Municipalidad could not undertake to supply water to this sector of Peñas Blancas, without any further explanation.That information was conveyed to the other individuals, as recorded in the minutes of the meeting held on September 25 of that year. They explain that things proceeded normally for some time, but in January 2024 they learned that the property from which they obtained the water had been sold to a foreign national. Therefore, when they contacted the former owner, he told them that he saw no problem with continuing the arrangement and that he would contact the current owner. However, “(...) the person responsible for maintaining the pipeline that supplied us with water informed us that he had found the hoses used to fill the tanks at the original source cut with a machete. In light of these events, we again contacted Mr. Nombre01 to ask whether he knew anything about them, and several days later he told us that the American who made the purchase had ordered the tanks and hoses removed from the property and instructed that no one from the group enter the property until he informed us when we could retrieve the materials belonging to us.As the days passed and we had neither water nor any news from Mr. Nombre67104, two members of the group went to inspect the site in March and found that the tanks and some of our hoses had been taken and redirected toward a water tanker that we assume belongs to the new owner, although Mr. Nombre01 informed us that he is still a partner and that the transaction has not been finalized. This incident was also reported to Mr. Nombre01, who showed little interest in resolving the improper taking of materials purchased with funds from this group. Given the impossibility of reaching any agreement with Mr. Nombre67104 and his refusal to provide us with a means of contacting his partner and prospective purchaser, the group decided to submit, for the third time, a request for water service to the current head of the Municipal Waterworks, Mr. Víctor Meza Calderón, who, in official letter AMSEACUE-0114-2024, merely states in a single line and without further explanation that ‘...there is neither water availability nor hydraulic capacity.’ This effectively disregarded the entire description provided in the request, in which we also expressed our willingness to assist in whatever way necessary to find a definitive solution to our need and requested an inspection of both the Nombre67105 spring—from which all of Peñas Blancas is supplied (including the street on which our properties are located)—and the spring from which, until February of this year and for more than 20 years, we had been provided with water, which is located on Mr. Nombre67104’s property.”
  2. 2By decision issued at 08:34 hours on April 30, 2022, the present proceeding was admitted for consideration.
  3. 3Juan Manuel Quesada Espinoza, Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, states under oath that: “in accordance with the Field Information Collection Report for the Paraíso waterworks and the Improvement Plan for the Paraíso municipal waterworks, forwarded to the Municipalidad de Paraíso pursuant to official letter PRE-2020-00024, the actions carried out by AyA, as the governing authority for the provision of drinking-water supply and wastewater-treatment services, through the Unidad Técnica de Prestación de los Servicios de Aguas Potable y Saneamiento del AYA – UTSAPS, are described, and regarding those actions we state as follows: In September 2022, that unit issued the Field Information Collection Report for the Paraíso de Cartago Waterworks, resulting from joint work between the person in charge of the Paraíso Waterworks and AyA, for the purpose of verifying the existing disinfection points in the waterworks and confirming the number of drinking-water supply systems that comprise it.It should be noted that this action forms part of the follow-up to the intervention process (proceso de Intervención) involving the Paraíso municipal waterworks pursuant to Board of Directors Resolution 2021-211 (documentary evidence #1), which in turn refers to Health Order MS-DRRSCE-DARSP-OS-0159-2019, issued by the Dirección Regional de Rectoría de la Salud Central Este, Dirección Área Rectora de Salud de Paraíso. That order remains in effect and establishes the following as its sole directive: ‘Intervene in the waterworks administered by the Municipalidad de Paraíso and submit a schedule of activities specifying the respective firm dates for the actions to be undertaken to guarantee the supply of drinking water to residents of the affected sectors of the canton of Paraíso.’ For those purposes, AyA issued the IMPROVEMENT PLAN FOR THE PARAÍSO MUNICIPAL WATERWORKS, as stated in official letter PRE-2020-00024 dated January 15, 2020, which guides the municipal operator’s management and decision-making regarding the following components:

Part A, “Optimization of the Aqueduct: Plan for Updating Technical Studies and Proposal for Improving the Water Supply.” Part B, “Optimization of the Aqueduct: Maintenance Plan for the Main Components of the Aqueduct Infrastructure.” Part C, “Optimization of the Aqueduct: Protocol for the Distribution of Drinking Water by Tanker Trucks.” Part D, “Optimization of the Aqueduct: Drinking-Water Quality Plan.” With respect to the “Part A” component, it entails establishing a strategy to develop and carry out all necessary actions, with the Municipality of Paraíso, in its capacity as operator, duly allocating human, financial, and material resources so that the technical studies can be updated and the proposal for improving the population’s water supply can be defined, under a comprehensive master-plan approach encompassing all the systems that make up the aqueduct, as detailed in document PRE-2020-00024 and its attachment, “IMPROVEMENT PLAN FOR THE PARAÍSO MUNICIPAL AQUEDUCT—INTERVENTION PROCESS UNDER HEALTH ORDER MS-DRRSCE-DARSP-OS-0159-2019” (documentary evidence #2).

As part of the technical follow-up sessions concerning the foregoing, the need was identified to validate the number and configuration of the systems that make up the Paraíso Aqueduct, based on their operating conditions at that time. This was verified and documented in the “Report on the Collection of Field Information at the Paraíso de Cartago Aqueduct” (documentary evidence #3). That report identifies the Nombre67105 System, which, based on its service area, is the system closest to the sector known as Dirección7400. Taking into consideration the location of property number Dirección01 (approximately 537 m in a straight line from the bridge over the Río Naranjo) and survey plan (plano) C-0807977-2002, according to information provided by Ms. [Nombre62 005], who was contacted through telephone number Telf04, it was determined that Dirección7401 is located beyond the bridge over the Río Naranjo, along an agricultural easement (servidumbre agrícola), as detailed in the following images, which form part of the Report on the Collection of Field Information at the Paraíso Aqueduct and the Improvement Plan for the Paraíso Municipal Aqueduct, transmitted to the Municipality of Paraíso pursuant to official letter PRE-2020-00024: Figure 1, “Coverage of the Nombre67105 System and Current Location of Dirección7401, Using Property Number 74822 as a Reference”; Figure 2, “Operational Diagram of the Nicanor System” (2022); Figure 3, “Coverage of the Nombre67105 System as Part of the Paraíso de Cartago Aqueduct” (2022); Figure 4a, “Location of Property Number 74822-000 in the Cadastral Information System” (02/05/2024); Figure 4b, “Location of Property Number 74822-000 in the Cadastral Information System” (02/05/2024); Figure 5, “Survey Plan C-0807977-2002 for Property Number 74822-000.” Given that the Nombre67105 System is operated by the Municipality of Paraíso, analyzing its water availability and hydraulic capacity (capacidad hídrica e hidráulica) is the direct responsibility of this municipal operator, as is determining the improvements required by that system to increase such capacity if a technical deficit is confirmed.

These technical studies are precisely what the Executive Presidency of AyA has been requesting since 2020 for all the systems that make up the Paraíso Aqueduct, and they can be carried out through the “IMPROVEMENT PLAN FOR THE PARAÍSO MUNICIPAL AQUEDUCT—INTERVENTION PROCESS UNDER HEALTH ORDER MS-DRRSCE-DARSP-OS-0159-2019.” Throughout this intervention process, it has been evident that the Municipality of Paraíso has allocated limited human and financial resources to comply with the aforementioned improvement plan and, in particular, to establish a strategy for preparing the terms of reference and proceeding with at least one procurement process to implement the Paraíso Aqueduct Master Plan (Part A of the Improvement Plan). This would produce the technical studies needed to analyze the water availability and hydraulic capacity of all 15 systems that make up the aqueduct, propose the required improvements, and include a strategy for implementing and financing those improvements.

The latest document issued in this process, to which a response from the Municipality of Paraíso remains pending, is PRE-2023-00571 of May 17, 2023 (documentary evidence #4), together with the repeated requests for a response recorded in official letters PRE-2023-00869 of July 07, 2023, PRE-2023-01337, and PRE-2023-01338 of October 05, 2023 (documentary evidence #5).

It is important to reiterate that a master plan typically covers a design period of approximately 25 or 30 years, which requires the studies to include, among other matters, the following: an assessment based on current service-delivery conditions; delineation of the current and potential service area; population projections and calculation of drinking-water consumption for the design period; characterization and quantification of the flow of water required to meet current and potential demand, which in turn entails identifying current and potential water sources and conducting hydrological, hydrogeological, and water-quality studies; quantification of the personnel and equipment needed to operate and maintain each system; environmental impact studies (estudios de impacto ambiental); economic feasibility studies; and their effect on the rate structure and debt-service model for any investments that may be determined.

As part of this intervention process and in connection with the preparation of a master plan, AyA also provided the Municipality of Paraíso with the guide entitled “Proposed Structure for Preparing Terms of Reference for a Master Plan for Drinking-Water Supply and Water-Resource Management, 2021,” as detailed in documents UEN-PC-2021-00788 and PRE-2021-00650 (documentary evidence #6). To date, however, the municipality has neither responded to the requests for information nor made progress on the terms of reference or a bidding process that would enable it to obtain the Paraíso Aqueduct Master Plan. That plan must address the aqueduct’s sustainability in terms of water availability and hydraulic and financial capacity for the next 25 years and must include all 15 systems that make it up.

SUBSTANTIVE CONSIDERATIONS Pursuant to Article 1 of the Ley Constitutiva de AyA, the Institute is responsible for administering and operating the aqueduct and sanitary sewer systems (sistemas de acueducto y alcantarillado sanitario) under its jurisdiction. In the canton of Paraíso, the Municipality is currently the operator of the drinking-water and wastewater-sanitation services and is therefore also responsible for administering, operating, and maintaining those services in good working order. For that reason, only the system operator can provide a complete report on the characteristics and condition of the aqueduct serving the coverage areas. Likewise, responsibility for administering and operating those systems rests with the Municipality of Paraíso. Accordingly, the basic conditions of the service result from its proper or improper management and administration, matters with which the municipal officials assigned to the local aqueduct must be familiar.

Furthermore, given that the Municipality retains jurisdiction over the administration of the aqueduct and sewer system, and because public institutions are governed by the Principle of Legality (Principio de Legalidad) enshrined in Article 11 of our Carta Magna and Article 11 of the Ley General de la Administración Pública—a principle that requires every Public Administration to act in accordance with the legal system and, therefore, also with budgetary legality—we must comply with express statutory provisions that prohibit investments in systems not administered by AyA, as provided in the Ley Constitutiva de AyA, Ley Financiera de la República y de Presupuestos Públicos and, in particular, Article 10 of the Ley General de Agua Potable (emphasis added). That article clearly establishes responsibility for and the permitted use of the financial resources received by each municipality for providing the public services of drinking-water supply and wastewater treatment.

It is essential to recall that, under its Ley Constitutiva, AyA has a dual role as both an operator and a governing authority (ente rector). As an operator, it must conduct the necessary studies, seek financial, human, and technical resources, and, of course, identify or locate the potentially usable water sources or water resources needed to provide service to its users. Its governing powers include the authority to issue the necessary directives and recommendations to the various operators nationwide concerning the provision of the public services of drinking-water supply and wastewater sanitation.

Accordingly, the technical criteria and recommendations issued by AyA in the exercise of its powers apply generally to the aqueduct systems and are necessary for their proper administration and management, as AyA has been doing through the intervention process involving the aqueduct administered by the Municipality of Paraíso, as explained above. As an essential aspect of that process, we may cite the Improvement Plan for the Paraíso Municipal Aqueduct, divided into the following components: Part A, “Optimization of the Aqueduct: Plan for Updating Technical Studies and Proposal for Improving the Water Supply.” Part B, “Optimization of the Aqueduct: Maintenance Plan for the Main Components of the Aqueduct Infrastructure.” Part C, “Optimization of the Aqueduct: Protocol for the Distribution of Drinking Water by Tanker Trucks.” Part D, “Optimization of the Aqueduct: Drinking-Water Quality Plan.” Despite all the recommendations issued by this Institute, the municipality has failed to address those directives efficiently and effectively, demonstrating the clear and evident current problems described in this proceeding.

Accordingly, in this specific case, despite the extensive efforts made by this Institute, AyA neither operates nor administers the drinking-water supply system or the wastewater-sanitation system in the Paraíso area. As stated supra, the system is administered by the Local Government, with the aggravating circumstance that serious problems have persisted over the years without corrective measures being adopted for the short, medium, and long term.

The Honorable Justices must understand that AyA is not a co-administrator of the Paraíso system; it exercises the powers conferred by the legislature in Ley N° 2726, while the Municipality of Paraíso is the operator and administrator of that system pursuant to subsection g) of the Ley Constitutiva de AyA, N° 2726, which states: “The systems currently administered and operated by municipal corporations may remain under their responsibility as long as they provide efficient service.” The Institute has provided extensive technical support and has participated and coordinated with the Local Government to find solutions to the various needs affecting the communities of the Canton; in that regard, AyA has fulfilled more than its obligation as governing authority.

Likewise, it is important to reiterate that the technical recommendations made by the Institute to the local government must be implemented immediately by the latter in order to effectively guarantee the human right of access to drinking water (agua potable), since it must not be overlooked that the local government itself is responsible for addressing the supply problems affecting the community of Dirección7400. As mandated by the Ley de Planificación Urbana, the Municipalidad de Paraíso must require performance guarantees (garantías reales de cumplimiento) for the construction and delivery of infrastructure works (aqueduct/sewerage); accordingly, such municipal negligence (together with the fact that the problem is located within the aqueduct’s service area) obliges that municipal corporation to resolve the supply problem, for which purpose AyA is willing to provide all necessary technical assistance. Based on the foregoing, the Municipalidad de Paraíso, as operator of the water-supply and wastewater-sanitation system (sistema de abastecimiento y saneamiento de aguas residuales), is responsible, as the entity charged with safeguarding local interests, for also verifying within its jurisdiction the proper operation and supply of drinking water.”

  1. 4Michel Álvarez Quirós, Mayor of the Municipality of the Canton of Paraíso, states under oath that, although it is true that the Municipality of Paraíso operates a municipal water-supply system (acueducto municipal), the municipal water-supply system does not operate throughout the canton; rather, in some locations within the canton, drinking water is supplied by legally constituted ASADAs. Although on several occasions one of the petitioners has requested drinking water from the Municipal Corporation, he has always been informed that the Municipality cannot provide him with this precious resource because there is insufficient water-source capacity (capacidad hídrica) and hydraulic capacity (capacidad hidráulica). This is because there is neither a water network nor any springs (nacientes) under concession to the Municipality near the properties through which it could provide the requested service. In other words, the Municipality of Paraíso is technically unable to provide the service because there is no infrastructure in the area.
  2. 5The legal requirements have been observed in the proceedings conducted.

Justice Alvarado Paniagua is the authoring judge; and,

Whereas:

I. SUBJECT MATTER OF THE PETITION

The petitioners state that they own and reside on land located at Dirección7399, in Peñas Blancas de Cachí. They allege that this area has never had municipal drinking-water service or a water supply provided by ICAA or any ASADA. Accordingly, they state that, to meet their need for water, a smaller group obtained authorization from a third party more than 20 years ago to use the spring located on that party’s property. Subsequently, because they lacked access to water resources (recurso hídrico), they requested drinking-water service from the Municipality of Paraíso for the first time. The request was denied on the ground, as stated in official letter 2015-09-09 MUPAACUE-1234-2015, that no drinking-water network belonging to the Municipality’s supply system is located near the property. In January 2024, they learned that the property from which they obtained water had been sold to a foreign national.

They submitted a request for water service to the current head of the Municipal Water-Supply System, but through official letter AMSEACUE-0114-2024 they were informed: “...there is no water-source capacity or hydraulic capacity.” This effectively disregarded the entire description provided in their request, in which they also expressed their willingness to assist in whatever manner necessary to find a permanent solution and requested an inspection both of the Nombre67105 spring—from which all of Peñas Blancas is supplied (including the street where the properties are located)—and of the spring located on a third party’s property that had supplied them with water until February of this year and for more than 20 years.

II. PROVEN FACTS

The following facts are deemed duly established and relevant to the determination of this matter, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:

Instituto Costarricense de Acueductos y Alcantarillados:

1. Pursuant to the Field Information Collection Report for the Paraíso Water-Supply System and the Improvement Plan for the Paraíso Municipal Water-Supply System, transmitted to the Municipality of Paraíso through official letter PRE-2020-00024, the actions undertaken by AyA, as the governing authority for the provision of drinking-water supply and wastewater-treatment services, through the AYA Technical Unit for the Provision of Drinking Water and Sanitation Services—UTSAPS, were described (see electronic record).

2. In September 2022, the AYA Technical Unit for the Provision of Drinking Water and Sanitation Services—UTSAPS of the respondent Municipality issued the Field Information Collection Report for the Paraíso de Cartago Water-Supply System. This report was the product of joint work by the official responsible for the Paraíso Water-Supply System and AyA, undertaken to verify the existing disinfection points in the system and confirm the number of drinking-water supply systems comprising it. This work formed part of the follow-up to the intervention process (proceso de intervención) involving the Paraíso Municipal Water-Supply System pursuant to Board of Directors Resolution 2021-211, which in turn refers to Health Order MS-DRRSCE-DARSP-OS-0159-2019, issued by the Dirección Regional de Rectoría de la Salud Central Este, Dirección Área Rectora de Salud de Paraíso. That order remains in force and establishes the following as its sole directive: “Intervene in the Water-Supply System administered by the Municipality of Paraíso and submit a schedule of activities stating the specific respective dates of the actions to be undertaken to guarantee the supply of drinking water to residents of the affected sectors of the canton of Paraíso.” (see electronic record).

3. AyA issued the IMPROVEMENT PLAN FOR THE PARAÍSO MUNICIPAL WATER-SUPPLY SYSTEM, as stated in official letter PRE-2020-00024 dated January 15, 2020. The Plan guided the municipal operator’s management and decision-making toward the following components: Part A, “Water-Supply System Optimization: Plan for Updating Technical Studies and Proposal for Improving Supply.” Part B, “Water-Supply System Optimization: Maintenance Plan for the Main Water-Supply Infrastructure Components.” Part C, “Water-Supply System Optimization: Protocol for Distributing Drinking Water by Tanker Truck.” Part D, “Water-Supply System Optimization: Drinking-Water Quality Plan” (see electronic record).

4. The “Part A” component entails establishing a strategy to develop and carry out all necessary actions, with the Municipality of Paraíso, in its capacity as operator, duly allocating human, financial, and material resources. This would allow the technical studies to be updated and the proposal for improving the population’s water supply to be defined under a comprehensive master-plan approach encompassing all systems comprising the water-supply system, as detailed in document PRE-2020-00024 and its attachment, “IMPROVEMENT PLAN FOR THE PARAÍSO MUNICIPAL WATER-SUPPLY SYSTEM: INTERVENTION PROCESS UNDER HEALTH ORDER MS-DRRSCE-DARSP-OS-0159-2019” (see electronic record).

5. During the technical follow-up sessions concerning the foregoing, the need was identified to confirm the number and configuration of the systems comprising the Paraíso Water-Supply System based on their operating conditions at that time. This was verified and documented in the “Field Information Collection Report for the Paraíso de Cartago Water-Supply System.” That report identified the Nombre67105 System, which, based on its supply area, is the system closest to the sector known as Dirección7400. Taking into account the location of the property bearing property number Dirección7402 (approximately 537 m in a straight line from the bridge over the Río Naranjo) and survey plan C-0807977-2002, according to information provided by petitioner [Nombre62 005], Dirección7401 was identified as being located beyond the bridge over the Río Naranjo, along an agricultural easement (servidumbre agrícola). These findings form part of the Field Information Collection Report for the Paraíso Water-Supply System and the Improvement Plan for the Paraíso Municipal Water-Supply System, transmitted to the Municipality of Paraíso through official letter PRE-2020-00024 (see electronic record).

6. Given that the Nombre67105 System is operated by the Municipality of Paraíso, analyzing its water-source and hydraulic capacity is the direct responsibility of that municipal operator, as is determining the improvements required to increase that capacity if a technical deficit is established. These are precisely the types of technical studies that AyA’s Executive Presidency has been requesting since 2020 for all systems comprising the Paraíso Water-Supply System. They can be implemented through the “IMPROVEMENT PLAN FOR THE PARAÍSO MUNICIPAL WATER-SUPPLY SYSTEM: INTERVENTION PROCESS UNDER HEALTH ORDER MS-DRRSCE-DARSP-OS-0159-2019” (see electronic record).

7. The most recent document issued in connection with this process is PRE-2023-00571 dated May 17, 2023. The respondent Institute’s repeated requests for a response are documented in official letters PRE-2023-00869 dated July 07, 2023, and PRE-2023-01337 and PRE-2023-01338 dated October 05, 2023 (see electronic record).

8. As part of this intervention process and with respect to formulating a master plan, AyA provided the Municipality of Paraíso with the guide entitled “Proposed Structure for Preparing Terms of Reference for a Master Plan for Drinking-Water Supply and Water-Resource Management, 2021,” as detailed in documents UEN-PC-2021-00788 and PRE-2021-00650. To date, however, the Municipality has neither responded to the requests for information nor made progress on the terms of reference or a procurement process that would enable it to obtain a Master Plan for the Paraíso Water-Supply System addressing the system’s sustainability in terms of its water-source, hydraulic, and financial capacity for the next 25 years and encompassing the 15 systems that comprise it (see electronic record).

9. In the canton of Paraíso, the respondent Municipality currently operates the drinking-water and wastewater-sanitation services (see electronic record).

Municipality of Paraíso:

1. The Municipality of Paraíso operates a municipal water-supply system that does not serve the entire territory of the canton; rather, in some locations within the canton, drinking water is supplied by legally constituted ASADAs (see electronic record).

2. In response to the petitioners’ request for drinking water, the Municipal Corporation informed them that the Municipality could not provide the water resource because it lacked water-source and hydraulic capacity. This is because there is neither a water network nor any springs under concession to the Municipality near the properties through which it could provide the requested service. The Municipality is therefore technically unable to provide the service because there is no infrastructure in the area (see electronic record).

III. BACKGROUND

This Court has held that, although there is a fundamental right (derecho fundamental) to drinking water, its exercise is not unrestricted, since entities providing that service are not obligated to provide it under any and all conditions or at any time. Thus, in Judgment N° 2010-1516 at 18:36 hours on January 26, 2010, this Chamber addressed the technical or legal impediments to providing drinking-water service. On that occasion, it held as follows: “IV.- On how the legal or formal impossibility of providing drinking-water service does not violate fundamental rights.- The settled case law (jurisprudencia) of this Chamber has indicated that, under the Costa Rican legal system, the supply of drinking water is considered a public service (servicio público) and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously, efficiently, under equal conditions, and in a manner that adapts to technological changes (see, in this regard, Judgment 2001-09676 at eleven hours and twenty-five minutes on September twenty-six, two thousand one, and Judgment 2004-08161 at ten hours and fifty-three minutes on July twenty-three, two thousand four).

In this regard, it is clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for providing the public drinking-water service, is likewise required to provide this service continuously, adaptably, efficiently, and equally to all inhabitants. Nevertheless, despite all that has just been established, the case law of this Constitutional Court has also indicated that, in the face of a legal impossibility (that is, failure to satisfy the requirements established in the applicable regulations) or a formal impossibility (that is, the absence of a Water Distribution Network), it is reasonable not to fulfill service requests or to require the interested party to bear the installation costs when no drinking-water distribution network exists and infrastructure must be built. Thus, in such cases, it has been made clear that this is not a denial of access to drinking-water service, but rather an impossibility of providing it or the necessary participation of the interested party in overcoming a technical impediment, namely, the lack of infrastructure.

Of course, AyA, as a state entity primarily responsible for providing drinking-water service, is obligated to continue expanding its infrastructure so that more and more people have access to this precious resource; however, while gaps remain, cooperation from interested parties is essential (see Resolutions N.º 2006-014218 at fifteen hours and four minutes on September twenty-six, two thousand six, and Nº 2007-11190 at fourteen hours and thirty-six minutes on August seven, two thousand seven). In other words, provided that the failure to furnish drinking-water service is not capricious, arbitrary, or unfounded, but is instead justified by a legal or material impossibility, there is no violation of fundamental rights.”

IV. THE SPECIFIC CASE

With reference to the preceding recital, it has been established that, in September 2022, the Unidad Técnica de Prestación de los Servicios de Aguas Potable y Saneamiento del AYA – UTSAPS of the respondent municipality issued the Field Information Collection Report for the Paraíso de Cartago Water-Supply System, resulting from joint work between the person responsible for the Paraíso Water-Supply System and AyA, with the objective of verifying the existing disinfection points in the water-supply system and validating the number of drinking-water supply systems comprising it, as part of the monitoring of the intervention process involving the Paraíso municipal water-supply system. Under Board of Directors Resolution 2021-211, which in turn refers to Health Order MS-DRRSCE-DARSP-OS-0159-2019, issued by the Dirección Regional de Rectoría de la Salud Central Este, Dirección Área Rectora de Salud de Paraíso—an order currently in effect—the sole directive is to intervene in the Water-Supply System administered by the Municipalidad de Paraíso and submit a schedule of activities indicating the corresponding definite dates for the actions to be undertaken to guarantee the supply of drinking water to citizens in the affected sectors of the canton of Paraíso.

AyA issued the PARAÍSO MUNICIPAL WATER-SUPPLY SYSTEM IMPROVEMENT PLAN, as recorded in official letter PRE-2020-00024 dated January 15, 2020, which guided the municipal operator’s management and decision-making toward the following components: Part A, “Optimization of the water-supply system: Plan for updating technical studies and proposal for improving supply.” Part B, “Optimization of the water-supply system: Maintenance plan for the principal water-supply infrastructure components.” Part C, “Optimization of the Water-Supply System: Protocol for distributing drinking water by tanker trucks.” Part D, “Optimization of the Water-Supply System: Drinking-water quality plan.” The respondent institute adds that the “Part A” component entails establishing a strategy to develop and carry out all necessary actions, with the proper allocation of human, financial, and material resources by the Municipalidad de Paraíso in its capacity as operator, allowing the technical studies to be updated and the proposal for improving supply to the population to be defined under a comprehensive master-plan approach encompassing all systems comprising the water-supply system.

As part of the technical monitoring sessions concerning the foregoing, the need was identified to validate the number and configuration of the systems comprising the Paraíso Water-Supply System, based on its operating conditions at that time; this was verified and documented in the “Field Information Collection Report for the Paraíso de Cartago Water-Supply System.” That report identified the Nombre67105 System, which, based on its supply area, is the system closest to the sector known as Dirección7400, mentioned here by the appellant. Taking into account the location of property registered under land-record number Dirección7402 (at an approximate straight-line distance of 537 m from the bridge over the Río Naranjo) and survey plan C-0807977-2002, according to information provided by the appellant [Nombre62 005], it was determined that Dirección7401 is located beyond the bridge over the Río Naranjo, along an agricultural easement (servidumbre agrícola).

These matters form part of the Field Information Collection Report for the Paraíso Water-Supply System and the Paraíso Municipal Water-Supply System Improvement Plan, transmitted to the Municipalidad de Paraíso under official letter PRE-2020-00024. Considering that the Nombre67105 System is operated by the Municipalidad de Paraíso, analysis of its water availability and hydraulic capacity is the direct responsibility of that municipal operator, as is determining the improvements the system requires to increase that capacity if a technical deficit is confirmed. The most recent document issued in this process is PRE-2023-00571 dated May 17, 2023, together with the repeated requests for a response recorded in official letters PRE-2023-00869 dated July 07, 2023, and PRE-2023-01337 and PRE-2023-01338 dated October 05, 2023. It has also been established that, as part of this intervention process and with respect to the formulation of a master plan (plan maestro), AyA provided the Municipalidad de Paraíso with the guide entitled “Proposed structure for preparing Terms of Reference for a Master Plan for Drinking-Water Supply and Water-Resource Management, 2021,” as detailed in documents UEN-PC-2021-00788 and PRE-2021-00650.

To date, however, the municipality has not responded to the requests for information or made progress on the terms of reference or a bidding process that would enable it to obtain the Paraíso Water-Supply System Master Plan, addressing the water availability and hydraulic and financial sustainability of the water-supply system for the next 25 years and including the 15 systems comprising it. In the canton of Paraíso, the respondent Municipality is currently the operator of the drinking-water and wastewater sanitation services and is therefore also responsible for administering, operating, and maintaining those services in proper working condition. For that reason, only the system operator can provide a complete report on the characteristics and condition of the water-supply system serving the coverage areas. Regarding the statements made by the respondent institute, no violation of the appellant’s fundamental rights has been established, since the appropriate measures have been taken.

As the respondent municipality is the operator of the municipal water-supply system, it stated in its report that the municipal water-supply system does not operate throughout the canton; rather, in some locations within the canton, drinking-water service is provided by legally constituted ASADAs. In response to the appellant’s request for drinking water, the Municipal Corporation stated that the municipality cannot provide the water resource because it lacks both water availability and hydraulic capacity. This is because there is neither a network near the properties nor any springs (nacientes) under concession to the Municipality for providing the requested service, which constitutes a technical impossibility of providing the service because no infrastructure exists in the area. Accordingly, although there is no pending application requiring resolution, a material, scientific, and legal impossibility exists—specifically, a lack of hydraulic capacity to provide the appellants with drinking-water service.

Therefore, in accordance with the settled precedents of this Chamber, the proper course is to dismiss the application for amparo relief (recurso de amparo), since the failure to furnish drinking-water service is justified by the prevailing impossibility of providing that service.

V.Although it is true that provision of the service is limited by the circumstances explained in the preceding recital, it is no less true that the affected community requires the water resource while a comprehensive solution to the problem is sought. Therefore, the municipal authorities must take the appropriate steps to guarantee the supply of drinking water to the affected community by means of tanker trucks or another alternative, so that the population is not adversely affected.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the Court Office within a maximum period of thirty business days, calculated from notice of this judgment. Otherwise, any material not collected within that period will be destroyed, in accordance with the provisions of the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in Session N° 27-11, dated August 22, 2011, Article XXVI, and published in Boletín Judicial N° 19, dated January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in Session N° 43-12, held on May 3, 2012, Article LXXXI.

POR TANTO:

The application is DISMISSED. The municipal authorities shall take note of the penultimate recital of this judgment. Notice shall be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del cinco de julio de dos mil veinticuatro .

Recurso de amparo interpuesto por [Nombre62 001], [Valor 001], [Nombre62 002], [Valor 002], [Nombre62 003], [Valor 003], [Nombre62 004], [Valor 004], [Nombre62 005], [Valor 005], contra la INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS Y LA MUNICIPALIDAD DE PARAÍSO.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala el 24 de abril de 2024, la parte recurrente interpuso recurso de amparo y manifiesta que, son propietarios y habitantes de terrenos ubicados en la Dirección7399 , en Peñas Blancas de Cachí. Dicha zona, aducen, nunca ha contado con el servicio municipal de agua potable, ni con suministro de la misma por parte del ICAA o de alguna ASADA (no existe ninguna constituida a la fecha para administrar los pozos y fuentes o nacientes de agua de la zona). Así las cosas, refieren que, para cubrir la necesidad de agua, un grupo más reducido, desde hace más de 20 años, obtuvo la autorización del señor Nombre01, para usar la naciente que se encuentra en su finca. Por razones que desconocen, destacan que, alrededor de los años 2014 y 2015 y, por varios meses, el flujo de agua se suspendió, lo que obligó a los vecinos a recoger agua de lluvia para atender las necesidades domésticas, de sus animales y sus cultivos.A raíz de esa situación, [Nombre62 005], solicitó por primera vez a la Municipalidad de Paraíso el servicio de agua potable, misma que fue rechazada, alegando según consta en el oficio 2015-09-09 MUPAACUE-1234-2015, que no se encuentra cerca de la propiedad red de agua potable del sistema de abastecimiento de la Municipalidad. Esgrimen que a inicios de 2016 y, en vista de la imposibilidad de obtener el agua a través de las instituciones responsables, la gestionante y otro de los vecinos, buscaron a don Nombre01, quien estaba acompañado de su hijo Nombre67104 , a quien presentó como el dueño de la propiedad donde estaba la naciente. Desde ese momento don Nombre67104 los autorizó para que tomaran agua del sitio para abastecer sus propiedades. Esgrimen que "Para esos efectos, y unidos por la necesidad, conformamos un grupo que existe desde entonces, con la finalidad de hacer las inversiones necesarias para la compra, colocación y mantenimiento de las mangueras y llaves que llevan el agua desde la naciente a nuestras propiedades.El grupo, aunque informal, se reúne con periodicidad y se mantiene en contacto permanente. Cabe resaltar que la naciente se encuentra montaña adentro y debemos recorrer tres propiedades distintas para el acopio y el traslado del agua sin que hasta febrero de este año tuviéramos ninguna dificultad para acceder hasta la fuente de agua. Pasado 5 años desde la primera gestión, en octubre del 2021, por segunda vez, se solicitó al entonces jefe del Acueducto de la municipalidad, señor Juan Carlos Porras Pizarro, la dotación del servicio de agua, haciéndole ver que la manera en que estábamos abasteciéndonos, aunque suplía parcialmente del recurso, resultaba una forma riesgosa, porque dependíamos de los dueños de tres propiedades distintas para que el fluido llegara a nuestras propiedades, tal y como lo indicamos en el párrafo anterior, con quienes no mediaban más que acuerdos verbales que podrían cambiar al momento en que alguno de todos, o todos, variaran su disposición".Empero, hasta el mes de marzo de 2022, se les comunicó que la Municipalidad no podía asumir el compromiso de dotar de agua a este sector de Peñas Blancas, ello, sin dar mayor explicación. Esa información fue trasladada al resto de las personas, según consta en la minuta de la reunión realizada el 25 de septiembre de ese año. Detallan que por un tiempo las cosas transcurrieron con normalidad, pero para enero de 2024, se percataron que la finca de donde obtenían el agua, fue vendida a un extranjero. Por eso, al comunicarse con el antiguo dueño, este les dijo que no veía problema en que se continuara con el pacto y que se comunicaría con el actual propietario. Empero, "(...) la persona a cargo del mantenimiento de la tubería que nos suplía el agua, nos informó que encontró las mangueras que llenan los tanques en la fuente original cortadas con machete. Ante estos hechos, nuevamente nos comunicamos con el señor Nombre01 para preguntarle si conocía de esos hechos y días después nos indica que fue el estadounidense que compró quien dio orden de sacar los tanques y las mangueras de la propiedad y que nadie del grupo entrara a la fìnca hasta que nos avisara cuándo podíamos retirar los materiales que nos pertenecen.En vista de que pasaban los días y no teníamos ni agua ni noticia de don Nombre67104, dos compañeros del grupo fueron a inspeccionar en marzo encontrando que los tanques y parte de nuestras mangueras fueron tomadas para direccionarlas hacia una tanqueta que suponemos será del nuevo dueño, aunque según nos informó el señor Nombre01, él aún es socio y el trato no está finiquitado. Este hecho fue también comunicado al señor Nombre01 quien no mostró mayor interés en resolver la toma indebida de materiales que fueron comprados con fondos de este grupo. Vista la imposibilidad de llegar a acuerdo alguno con el señor Nombre67104 y su negativa a facilitamos la forma de comunicarnos con su socio y posible comprador, el grupo decidió hacer, por tercera vez, la solicitud del servicio de agua al actual jefe de Acueducto Municipal, señor Víctor Meza Calderón, quien mediante oficio AMSEACUE-0114-2024 en un renglón y sin mayores explicaciones, simplemente señala que "...no existe capacidad hídrica ni capacidad hidráulica".Esto prácticamente ignorando toda la descripción que realizaron en la solicitud, en donde también, le expusimos nuestra voluntad de apoyar en lo que sea necesario para encontrar una solución definitiva a nuestra necesidad y pidiéndole una inspección tanto de la naciente Nombre67105 -de la que se abastece a todo Peñas Blancas (al que pertenece la calle donde se ubican nuestras propiedades)- como la naciente de la que hasta febrero de este año y por más de 20 años se nos facilitaba el agua, la ubicada en la finca de don Nombre67104 ".
  2. 2Mediante resolución de las 08:34 horas del 30 de abril de 2022, se dio curso al presente recurso.
  3. 3Informan bajo juramento Juan Manuel Quesada Espinoza, Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, que: “de conformidad con el Informe de recopilación de información de campo en el acueducto de Paraíso y el Plan de mejoras del acueducto municipal de Paraíso, remitido a la Municipalidad de Paraíso según oficio PRE-2020-00024, se describen las acciones que ha realizado el AyA, como ente Rector en la prestación de servicios de abastecimiento de agua potable y tratamiento de las aguas residuales, a través de la Unidad Técnica de Prestación de los Servicios de Aguas Potable y Saneamiento del AYA – UTSAPS y sobre las que procedemos a indicar lo siguiente: En setiembre del 2022, dicha unidad emite el Informe de Recopilación de Información de Campo en Acueducto de Paraíso de Cartago, producto de un trabajo en conjunto entre el encargado del Acueducto de Paraíso y el AyA, con el objetivo de verificar los puntos de desinfección existentes en el acueducto y validar la cantidad de sistemas de abastecimiento de agua potable que conforman dicho acueducto.Cabe señalar que dicho accionar forma parte del seguimiento al proceso de Intervención al acueducto municipal de Paraíso según Acuerdo de Junta Directiva 2021-211 (prueba documental #1), el que a su vez refiere a la Orden Sanitaria MS-DRRSCE-DARSP-OS-0159-2019, generada por la Dirección Regional de Rectoría de la Salud Central Este, Dirección Área Rectora de Salud de Paraíso, orden actualmente vigente y en la que se establece como punto único el siguiente: “Intervenir el Acueducto administrado por la Municipalidad de Paraíso y presentar un cronograma de actividades donde se indiquen con las fechas ciertas respectivas las acciones que se realizarán a fin de garantizar el suministro de agua potable a los ciudadanos(as) de los sectores afectados del cantón de Paraíso.” Para tales efectos, el AyA emitió el PLAN DE MEJORAS DEL ACUEDUCTO MUNICIPAL DE PARAÍSO según consta en el oficio PRE-2020-00024 de fecha 15 de enero del 2020, mismo que orienta la gestión y toma de decisiones del operador municipal hacia los siguientes componentes:

Parte A “Optimización del acueducto: Plan de actualización de estudios técnicos y propuesta de mejora en el abastecimiento”. Parte B “Optimización del acueducto: Plan de mantenimiento de componentes principales de infraestructura de acueducto”. Parte C “Optimización del Acueducto: Protocolo para distribución de agua potable mediante camiones cisterna”. Parte D “Optimización del Acueducto: Plan de calidad de agua potable”. Respecto al componente “Parte A”, el mismo conlleva el establecimiento de una estrategia para desarrollar y ejecutar todas las acciones necesarias, con la debida asignación de recursos humano, financiero y material por parte de la Municipalidad de Paraíso en calidad de ente operador, que permita llevar a cabo la actualización de los estudios técnicos y definición de la propuesta de mejora para el abastecimiento de la población, bajo un enfoque integral de plan maestro que contemple todo los sistemas que conforman el acueducto; tal y como se detalla en el documento PRE-2020-00024 y su adjunto “PLAN DE MEJORAS DEL ACUEDUCTO MUNICIPAL DE PARAÍSO PROCESO DE INTERVENCIÓN ORDEN SANITARIA MS-DRRSCE-DARSP-OS-0159-2019” (prueba documental #2).

Como parte de las sesiones técnicas para el seguimiento de lo indicado, se identificó la necesidad de validar la cantidad y configuración de los sistemas que conforman el Acueducto de Paraíso, según las condiciones de funcionamiento en ese momento, lo cual quedó verificado y evidenciado en el “Informe de Recopilación de Información de Campo en Acueducto de Paraíso de Cartago” (prueba documental #3). En este informe se identifica el Sistema Nombre67105 que según su área de abastecimiento es el más próximo al sector conocido como Dirección7400 y, tomando en consideración la ubicación de la propiedad número de finca Dirección01 (a una distancia aproximada en línea recta de 537 m desde el puente sobre el Río Naranjo) y plano C-0807977-2002, según dato aportado por la señora [Nombre62 005] a quién se le contacto a través del número telefónico Telf04, se identifica que Dirección7401 se ubica posterior al puente sobre el Río Naranjo sobre servidumbre agrícola, tal cual se detalla en las siguientes imágenes, que forman parte del Informe de recopilación de información de campo en el acueducto de Paraíso y el Plan de mejoras del acueducto municipal de Paraíso, remitido a la Municipalidad de Paraíso según oficio PRE-2020-00024: Figura 1 “Cobertura del Sistema Nombre67105 y ubicación actual de Dirección7401 tomando de referencia la finca número 74822” Figura 2 “Esquema operativo Sistema Nicanor” (2022) Figura 3 “Cobertura del Sistema Nombre67105 como parte del Acueducto de Paraíso de Cartago” (2022) Figura 4a “Ubicación de la finca número 74822-000 en el Sistema de Información Catastral” (02/05/2024) Figura 4b “Ubicación de la finca número 74822-000 en el Sistema de Información Catastral” (02/05/2024) Figura 5 “Plano C-0807977-2002 de la finca número 74822-000”.

Considerando que el Sistema Nombre67105 es operado por la Municipalidad de Paraíso, el análisis de su capacidad hídrica e hidráulica es responsabilidad directa de este operador municipal, así como el determinar las mejoras que requiere dicho sistema para incrementar esa capacidad de comprobarse que técnicamente presenta déficit. Este tipo de estudios técnicos son precisamente los que ha estado solicitando la Presidencia Ejecutiva del AyA desde el 2020 y para todos los sistemas que conforman el Acueducto de Paraíso, lo cual es posible de materializar a través del “PLAN DE MEJORAS DEL ACUEDUCTO MUNICIPAL DE PARAÍSO PROCESO DE INTERVENCIÓN ORDEN SANITARIA MS-DRRSCE-DARSP-OS-0159-2019”. A lo largo de este proceso de intervención ha sido evidente de parte de la Municipalidad de Paraíso la limitada asignación de recursos humano y financiero para cumplir con el plan de mejoras que se cita y de manera particular para establecer una estrategia que materialice la elaboración de los términos de referencia y proceda al menos con una contratación para hacer efectivo el Plan Maestro del Acueducto de Paraíso (Parte A del Plan de Mejoras) y de esta forma, generar los estudios técnicos que deriven en un análisis de la capacidad hídrica e hidráulica de todos los 15 sistemas que lo conforman, así como el planteamiento de las mejoras que son requeridas e incluya una estrategia de implementación y financiamiento de dichas mejoras.

El último documento emitido sobre este proceso cuya respuesta sigue pendiente de parte de la Municipalidad de Paraíso corresponde al PRE-2023-00571 del 17 de mayo del 2023 (prueba documental #4) y las reiteradas solicitudes de respuesta según consta en los oficios: PRE-2023-00869 del 07 de julio del 2023, PRE-2023-01337 y PRE-2023-01338 del 05 de octubre del 2023 (prueba documental #5). Es relevante insistir en que un plan maestro se caracteriza por abarcar un período de diseño alrededor de los 25 o 30 años, lo cual requiere que los estudios incluyan entre otros aspectos los siguientes: diagnóstico según condiciones actuales de prestación del servicio, delimitación del área de cobertura actual y potencial, proyecciones de población y cálculo de consumo de agua potable según el período de diseño, caracterización y cuantificación del caudal de agua requerida para abastecer la demanda actual y potencial que a su vez conlleva la identificación de las fuentes de agua actuales y potenciales y el levantamiento de los estudios hidrológicos, hidrogeológicos y de calidad del agua; así como la cuantificación del recurso humano y equipamiento para la operación y mantenimiento de cada sistema, estudios de impacto ambiental y de factibilidad económica y su repercusión en el modelo tarifario y de servicio de la deuda para las inversiones que se determinen.

También, como parte de este proceso de intervención y en lo relativo a la formulación de un plan maestro, el AyA le facilitó a la Municipalidad de Paraíso la guía “Propuesta de estructura para elaboración de Términos de Referencia para Plan Maestro de Abastecimiento de Agua Potable y Manejo del recurso hídrico, 2021” según se detalla en los documentos UEN-PC-2021-00788 y PRE-2021-00650 (prueba documental #6); sin embargo, a la fecha la municipalidad no ha brindado respuesta a las peticiones de información ni ha avanzado en los términos de referencia o en un proceso de licitación que le permita contar con el Plan Maestro del Acueducto de Paraíso, que responda a la sostenibilidad del acueducto en lo relativo a capacidad hídrica, hidráulica y financiera para los próximos 25 años, que incluya los 15 sistemas que lo conforman. CONSIDERACIONES DE FONDO Ahora bien, conforme al artículo 1 de la Ley Constitutiva de AyA, el Instituto es el encargado de administrar y operar sistemas de acueducto y alcantarillado sanitario bajo su competencia.

En el cantón de Paraíso, la Municipalidad es actualmente el operador del servicio de agua potable y saneamiento de aguas residuales, por ende, le corresponde además administrar, operar y mantener los servicios en buenas condiciones de funcionamiento. Por tal razón solo el operador del sistema puede dar un informe completo sobre las características y situación del acueducto que administran las áreas de cobertura. Así mismo, el responsable de la administración y operación de esos sistemas corresponde a la Municipalidad de Paraíso, debido a lo cual, las condiciones básicas del servicio obedecen a una adecuada o inadecuada gestión y administración de éste, que como tal lo deben conocer los funcionarios municipales destacados en el acueducto local. Igualmente, dada la competencia que conserva la Municipalidad en la administración del acueducto y alcantarillado y que como instituciones públicas nos encontramos regidos por el Principio de Legalidad consagrado en el artículo 11 de nuestra Carta Magna y numeral 11 de la Ley General de la Administración Pública; principio que somete a toda Administración Pública, actuar conforme al ordenamiento jurídico, y por tanto, también a la legalidad presupuestaria, debemos ajustarnos a disposiciones expresas de ley que inhiben de realizar inversiones en sistemas no administrados por AyA, tal y como se dispone en la Ley Constitutiva de AyA, Ley Financiera de la República y de Presupuestos Públicos y en especial, lo ordenado en el artículo 10 de la Ley General de Agua Potable (el resaltado es nuestro), que establece clara responsabilidad y uso respecto a los recursos financieros que perciba cada municipalidad por concepto del servicio público de abastecimiento de agua potable y tratamiento de aguas residuales.

Es fundamental, recordar que AyA tiene por su Ley Constitutiva un doble rol, como operador y como ente rector, siendo que como operador debe realizar los estudios necesarios, buscar recursos financieros, humanos, técnicos y obviamente determinar o ubicar las fuentes o recurso hídrico potencialmente utilizable para brindar el servicio a sus usuarios. Y dentro de sus competencias rectoras, se encuentra la facultad de emitir las directrices y recomendaciones necesarias a los distintos operadores a nivel nacional, para la prestación del servicio público de abastecimiento de agua potable y saneamiento de aguas residuales. Así las cosas, los criterios y recomendaciones técnicas que dicta el AyA en el ejercicio de sus competencias, son de aplicación general sobre los sistemas de acueducto necesarios para la adecuada administración y gestión, tal y como lo ha venido realizando el AyA por medio del proceso de intervención al acueducto que administra la Municipalidad de Paraíso, según lo arriba explicado y como aspecto esencial podemos indicar el Plan de mejoras del acueducto municipal de Paraíso dividido de la siguientes componentes: Parte A “Optimización del acueducto: Plan de actualización de estudios técnicos y propuesta de mejora en el abastecimiento”.

Parte B “Optimización del acueducto: Plan de mantenimiento de componentes principales de infraestructura de acueducto”. Parte C “Optimización del Acueducto: Protocolo para distribución de agua potable mediante camiones cisterna”. Parte D “Optimización del Acueducto: Plan de calidad de agua potable”. Pese a todas las recomendaciones emitidas por este Instituto, la municipalidad ha sido omisa en atender de forma eficiente y eficaz, dichas directrices, lo cual evidencia la evidente y clara problemática actual descrita en el presente recurso. Así las cosas, para el caso concreto, a pesar de los grandes esfuerzos que ha realizado este Instituto, el AyA no opera ni administra el sistema de abastecimiento de agua potable ni tampoco el de saneamiento de aguas residuales en la zona de Paraíso. Como fue indicado supra, se trata de un sistema administrado por el Gobierno Local, con el agravante que han persistido serios problemas a lo largo de los años, sin que se hayan tomado medidas correctivas a corto, mediano y largo plazo.

Ahora bien, deben comprender los señores magistrados que el AyA, no es un coadministrador del sistema de Paraíso, ostenta facultades dispuestas por el legislador en la Ley N° 2726 y la Municipalidad de Paraíso es el operador y administrador de dicho sistema, en virtud de lo indicado en el artículo inciso g) de la Ley Constitutiva de AyA, N° 2726 que indica: “Los sistemas que actualmente están administrados y operados por las corporaciones municipales podrán seguir a cargo de éstas, mientras suministren un servicio eficiente.” El instituto ha brindado un apoyo técnico amplio, participado y coordinado con el Gobierno Local para encontrar solución a las distintas necesidades que aquejan a las comunidades del Cantón, por lo que AyA en ese sentido, ha cumplido más allá de su obligación como rector. De igual forma, es importante reiterar que el cumplimiento de las recomendaciones técnicas que ha hecho el Instituto, al gobierno local, debe ser implementado de forma inmediata por éste, en aras de garantizar de forma efectiva el derecho humano de acceso al agua potable, pues no debe perderse de vista, que es el propio gobierno local quien debe atender la problemática de abastecimiento de la comunidad de Dirección7400 .

Conforme lo ordena la Ley de Planificación Urbana, la Municipalidad de Paraíso debe exigir garantías reales de cumplimiento en la construcción y entrega de las obras de infraestructura (acueducto/alcantarillado); de manera que, tal negligencia municipal (aunado al hecho de el área de influencia del acueducto donde se ubica la problemática) obliga a esa corporación a solucionar el problema de abastecimiento, para lo cual AyA está anuente a brindar toda la asesoría técnica necesaria. Con fundamento en los antecedentes, es responsabilidad de la Municipalidad de Paraíso, como operador del sistema de abastecimiento y saneamiento de aguas residuales, el ente encargado de velar por los intereses locales, como también verificar dentro de su jurisdicción el correcto funcionamiento y abastecimiento del agua potable”.

  1. 4Informa bajo juramento Michel Álvarez Quirós, alcalde de la Municipalidad del Cantón de Paraíso, que si bien es cierto la Municipalidad de Paraíso es operadora de un acueducto municipal, lo cierto del caso es que el acueducto municipal no opera en la totalidad del territorio del cantón, sino que hay lugares donde el suministro de agua potable dentro del cantón es brindado por asadas legalmente constituidas. A pesar de que en varias ocasiones uno de los recurrentes ha realizado la solicitud de agua potable a la Corporación Municipal, siempre se le ha indicado que la municipalidad no puede dotarlo de tan preciado líquido debido a que no hay capacidad hídrica ni hidráulica. Esto debido a que cerca de las fincas no existen red ni nacientes concesionadas por la Municipalidad para dar el servicio que solicitan. Es decir, la Municipalidad de Paraíso tiene una imposibilidad técnica para brindar el servicio porque no se cuenta con infraestructura en la zona.
  2. 5En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Alvarado Paniagua; y,

Considerando:

I. OBJETO DEL RECURSO

Señala la parte recurrente que, son propietarios y habitantes de terrenos ubicados en la Dirección7399 , en Peñas Blancas de Cachí. Dicha zona, aducen, nunca ha contado con el servicio municipal de agua potable, ni con suministro de la misma por parte del ICAA o de alguna ASADA. Así las cosas, refieren que, para cubrir la necesidad de agua, un grupo más reducido, desde hace más de 20 años, obtuvo la autorización de un tercero, para usar la naciente que se encuentra en su finca. Pasado el tiempo y en razón de no tener el recurso hídrico se solicitó por primera vez a la Municipalidad de Paraíso el servicio de agua potable, misma que fue rechazada, alegando según consta en el oficio 2015-09-09 MUPAACUE-1234-2015, que no se encuentra cerca de la propiedad red de agua potable del sistema de abastecimiento de la Municipalidad. Para enero de 2024, se percataron que la finca de donde obtenían el agua, fue vendida a un extranjero.

Realizaron la solicitud del servicio de agua al actual jefe de Acueducto Municipal, y mediante oficio AMSEACUE-0114-2024 no obstante, se les indicó; "...no existe capacidad hídrica ni capacidad hidráulica". Esto prácticamente ignorando toda la descripción que hicimos en la solicitud, en donde también, expusieron la voluntad de apoyar en lo que sea necesario para encontrar una solución definitiva, pidiendo una inspección tanto de la naciente Nombre67105 -de la que se abastece a todo Peñas Blancas (al que pertenece la calle donde se ubican las propiedades)- como la naciente de la que hasta febrero de este año y por más de 20 años les facilito el agua, la ubicada en la finca de un tercero.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

Instituto Costarricense de Acueductos y Alcantarillados:

1. De conformidad con el Informe de recopilación de información de campo en el acueducto de Paraíso y el Plan de mejoras del acueducto municipal de Paraíso, remitido a la Municipalidad de Paraíso según oficio PRE-2020-00024, se describieron las acciones que ha realizado el AyA, como ente Rector en la prestación de servicios de abastecimiento de agua potable y tratamiento de las aguas residuales, a través de la Unidad Técnica de Prestación de los Servicios de Aguas Potable y Saneamiento del AYA – UTSAPS (ver registro electrónico).

2. En setiembre del 2022, la Unidad Técnica de Prestación de los Servicios de Aguas Potable y Saneamiento del AYA – UTSAPS de la municipalidad recurrida, emitió el Informe de Recopilación de Información de Campo en el Acueducto de Paraíso de Cartago, producto de un trabajo en conjunto entre el encargado del Acueducto de Paraíso y el AyA, con el objetivo de verificar los puntos de desinfección existentes en el acueducto y validar la cantidad de sistemas de abastecimiento de agua potable que conforman dicho acueducto, el cual es parte del seguimiento al proceso de Intervención al acueducto municipal de Paraíso según Acuerdo de Junta Directiva 2021-211, el que a su vez refiere a la Orden Sanitaria MS-DRRSCE-DARSP-OS-0159-2019, generada por la Dirección Regional de Rectoría de la Salud Central Este, Dirección Área Rectora de Salud de Paraíso, orden actualmente vigente y en la que se establece como punto único el siguiente: “Intervenir el Acueducto administrado por la Municipalidad de Paraíso y presentar un cronograma de actividades donde se indiquen con las fechas ciertas respectivas las acciones que se realizarán a fin de garantizar el suministro de agua potable a los ciudadanos(as) de los sectores afectados del cantón de Paraíso.” (ver registro electrónico).

3. El AyA emitió el PLAN DE MEJORAS DEL ACUEDUCTO MUNICIPAL DE PARAÍSO según consta en el oficio PRE-2020-00024 de fecha 15 de enero del 2020, mismo que orientó la gestión y toma de decisiones del operador municipal hacia los siguientes componentes: Parte A “Optimización del acueducto: Plan de actualización de estudios técnicos y propuesta de mejora en el abastecimiento”. Parte B “Optimización del acueducto: Plan de mantenimiento de componentes principales de infraestructura de acueducto”. Parte C “Optimización del Acueducto: Protocolo para distribución de agua potable mediante camiones cisterna”. Parte D “Optimización del Acueducto: Plan de calidad de agua potable” (ver registro electrónico).

4. Respecto al componente “Parte A”, el mismo conlleva el establecimiento de una estrategia para desarrollar y ejecutar todas las acciones necesarias, con la debida asignación de recursos humano, financiero y material por parte de la Municipalidad de Paraíso en calidad de ente operador, que permita llevar a cabo la actualización de los estudios técnicos y definición de la propuesta de mejora para el abastecimiento de la población, bajo un enfoque integral de plan maestro que contemple todos los sistemas que conforman el acueducto; tal y como se detalla en el documento PRE-2020-00024 y su adjunto “PLAN DE MEJORAS DEL ACUEDUCTO MUNICIPAL DE PARAÍSO PROCESO DE INTERVENCIÓN ORDEN SANITARIA MS-DRRSCE-DARSP-OS-0159-2019” (ver registro electrónico).

5. Como parte de las sesiones técnicas para el seguimiento de lo indicado, se identificó la necesidad de validar la cantidad y configuración de los sistemas que conforman el Acueducto de Paraíso, según las condiciones de funcionamiento en ese momento, lo cual quedó verificado y evidenciado en el “Informe de Recopilación de Información de Campo en Acueducto de Paraíso de Cartago”. En dicho informe se identificó el Sistema Nombre67105 que según su área de abastecimiento es el más próximo al sector conocido como Dirección7400 y, tomando en consideración la ubicación de la propiedad número de finca Dirección7402 (a una distancia aproximada en línea recta de 537 m desde el puente sobre el Río Naranjo) y plano C-0807977-2002, según dato aportado por la recurrente [Nombre62 005], se identificó que Dirección7401 se ubica posterior al puente sobre el Río Naranjo sobre servidumbre agrícola, que forman parte del Informe de recopilación de información de campo en el acueducto de Paraíso y el Plan de mejoras del acueducto municipal de Paraíso, remitido a la Municipalidad de Paraíso según oficio PRE-2020-00024 (ver registro electrónico).

6. Considerando que el Sistema Nombre67105 es operado por la Municipalidad de Paraíso, el análisis de su capacidad hídrica e hidráulica es responsabilidad directa de este operador municipal, así como el determinar las mejoras que requiere dicho sistema para incrementar esa capacidad de comprobarse que técnicamente presenta déficit. Este tipo de estudios técnicos son precisamente los que ha estado solicitando la Presidencia Ejecutiva del AyA desde el 2020 y para todos los sistemas que conforman el Acueducto de Paraíso, lo cual es posible de materializar a través del “PLAN DE MEJORAS DEL ACUEDUCTO MUNICIPAL DE PARAÍSO PROCESO DE INTERVENCIÓN ORDEN SANITARIA MS-DRRSCE-DARSP-OS-0159-2019” (ver registro electrónico).

7. El último documento emitido sobre este proceso corresponde al PRE-2023-00571 del 17 de mayo del 2023, constan reiteradas solicitudes de respuesta según consta en los oficios: PRE-2023-00869 del 07 de julio del 2023, PRE-2023-01337 y PRE-2023-01338 del 05 de octubre del 2023 por parte del instituto recurrido (ver registro electrónico).

8. Como parte de este proceso de intervención y en lo relativo a la formulación de un plan maestro, el AyA le facilitó a la Municipalidad de Paraíso la guía “Propuesta de estructura para elaboración de Términos de Referencia para Plan Maestro de Abastecimiento de Agua Potable y Manejo del recurso hídrico, 2021” según se detalla en los documentos UEN-PC-2021-00788 y PRE-2021-00650, sin embargo, a la fecha la municipalidad no ha brindado respuesta a las peticiones de información ni ha avanzado en los términos de referencia o en un proceso de licitación que le permita contar con el Plan Maestro del Acueducto de Paraíso, que responda a la sostenibilidad del acueducto en lo relativo a capacidad hídrica, hidráulica y financiera para los próximos 25 años, que incluya los 15 sistemas que lo conforman (ver registro electrónico).

9. En el cantón de Paraíso, la Municipalidad recurrida es actualmente el operador del servicio de agua potable y saneamiento de aguas residuales (ver registro electrónico).

Municipalidad de Paraíso:

1. La Municipalidad de Paraíso es operadora de un acueducto municipal, el cual no opera en la totalidad del territorio del cantón, sino que hay lugares donde el suministro de agua potable dentro del cantón es brindado por asadas legalmente constituidas (ver registro electrónico).

2. Ante la solicitud de agua potable por parte de la parte recurrente la Corporación Municipal, se le ha indicado que la municipalidad no puede dotarlo del recurso hídrico, debido a que no hay capacidad hídrica ni hidráulica. Esto debido a que cerca de las fincas no existen red ni nacientes concesionadas por la Municipalidad para dar el servicio que solicitan, siendo esto una imposibilidad técnica para brindar el servicio porque no se cuenta con infraestructura en la zona (ver registro electrónico).

III. ANTECEDENTE

Este Tribunal ha considerado, que si bien existe un derecho fundamental al agua potable su ejercicio no es indiscriminado, ya que no hay una obligación de los entes que prestan ese servicio de brindarlo en cualesquiera condiciones y oportunidad. Así, esta Sala en la Sentencia N° 2010-1516 de las 18:36 horas del 26 de enero de 2010 se refirió a las imposibilidades técnicas o legales para brindar el servicio de agua potable. En esa oportunidad estableció lo siguiente: “IV.- Sobre como la imposibilidad jurídica o formal para dotar del servicio de agua potable no es violatorio de derechos fundamentales.- Reiterada jurisprudencia de esta Sala ha indicado que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos –sea sujeto público o sujeto privado- está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro).

En este sentido, resulta claro concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargado de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, a pesar de todo lo que se acaba de establecer, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura.

Por supuesto, el AyA como un ente estatal encargado mayormente de la prestación del servicio de agua potable, tiene la obligación de ir expandiendo su infraestructura para que tengan acceso a este preciado líquido cada vez más y más personas, pero mientras queden vacíos resulta indispensable la colaboración de los interesados (véase las resoluciones N.º 2006-014218 de las quince horas y cuatro minutos del veintiséis de septiembre del dos mil seis y Nº 2007-11190 de las catorce horas y treinta y seis minutos del siete de agosto del dos mil siete). En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales".

IV. SOBRE EL CASO CONCRETO

Tomando por referencia el considerando anterior, se tiene por demostrado que en setiembre del 2022, la Unidad Técnica de Prestación de los Servicios de Aguas Potable y Saneamiento del AYA – UTSAPS de la municipalidad recurrida, emitió el Informe de Recopilación de Información de Campo en el Acueducto de Paraíso de Cartago, producto de un trabajo en conjunto entre el encargado del Acueducto de Paraíso y el AyA, con el objetivo de verificar los puntos de desinfección existentes en el acueducto y validar la cantidad de sistemas de abastecimiento de agua potable que conformaban dicho acueducto, el cual es parte del seguimiento al proceso de Intervención al acueducto municipal de Paraíso. Según Acuerdo de Junta Directiva 2021-211, el que a su vez refiere a la Orden Sanitaria MS-DRRSCE-DARSP-OS-0159-2019, generada por la Dirección Regional de Rectoría de la Salud Central Este, Dirección Área Rectora de Salud de Paraíso, -orden actualmente vigente- se establece como punto único intervenir el Acueducto administrado por la Municipalidad de Paraíso y presentar un cronograma de actividades donde se indiquen con las fechas ciertas respectivas las acciones que se realizarán a fin de garantizar el suministro de agua potable a los ciudadanos(as) de los sectores afectados del cantón de Paraíso.

El AyA emitió el PLAN DE MEJORAS DEL ACUEDUCTO MUNICIPAL DE PARAÍSO según consta en el oficio PRE-2020-00024 de fecha 15 de enero del 2020, mismo que orientó la gestión y toma de decisiones del operador municipal hacia los siguientes componentes: Parte A “Optimización del acueducto: Plan de actualización de estudios técnicos y propuesta de mejora en el abastecimiento”. Parte B “Optimización del acueducto: Plan de mantenimiento de componentes principales de infraestructura de acueducto”. Parte C “Optimización del Acueducto: Protocolo para distribución de agua potable mediante camiones cisterna”. Parte D “Optimización del Acueducto: Plan de calidad de agua potable”. Acota el instituto recurrido que respecto al componente “Parte A”, el mismo conlleva el establecimiento de una estrategia para desarrollar y ejecutar todas las acciones necesarias, con la debida asignación de recurso humano, financiero y material por parte de la Municipalidad de Paraíso en calidad de ente operador, que permita llevar a cabo la actualización de los estudios técnicos y definición de la propuesta de mejora para el abastecimiento de la población, bajo un enfoque integral de plan maestro que contemple todos los sistemas que conforman el acueducto; como parte de las sesiones técnicas para el seguimiento de lo indicado, se identificó la necesidad de validar la cantidad y configuración de los sistemas que conforman el Acueducto de Paraíso, según las condiciones de funcionamiento en ese momento, lo cual quedó verificado y evidenciado en el “Informe de Recopilación de Información de Campo en Acueducto de Paraíso de Cartago”.

En dicho informe se identificó el Sistema Nombre67105 que según su área de abastecimiento es el más próximo al sector conocido como Dirección7400 mencionado aquí por la parte recurrente, y, tomando en consideración la ubicación de la propiedad número de finca Dirección7402 (a una distancia aproximada en línea recta de 537 m desde el puente sobre el Río Naranjo) y plano C-0807977-2002, según dato aportado por la recurrente [Nombre62 005], se identificó que Dirección7401 se ubica posterior al puente sobre el Río Naranjo sobre servidumbre agrícola, que forman parte del Informe de recopilación de información de campo en el acueducto de Paraíso y el Plan de mejoras del acueducto municipal de Paraíso, remitido a la Municipalidad de Paraíso según oficio PRE-2020-00024 Considerando que el Sistema Nombre67105 es operado por la Municipalidad de Paraíso, el análisis de su capacidad hídrica e hidráulica es responsabilidad directa de este operador municipal, así como el determinar las mejoras que requiere dicho sistema para incrementar esa capacidad de comprobarse que técnicamente presenta déficit.

El último documento emitido sobre este proceso corresponde al PRE-2023-00571 del 17 de mayo del 2023 y las reiteradas solicitudes de respuesta según consta en los oficios: PRE-2023-00869 del 07 de julio del 2023, PRE-2023-01337 y PRE-2023-01338 del 05 de octubre del 2023. También se tiene que, como parte de este proceso de intervención y en lo relativo a la formulación de un plan maestro, el AyA le facilitó a la Municipalidad de Paraíso la guía “Propuesta de estructura para elaboración de Términos de Referencia para Plan Maestro de Abastecimiento de Agua Potable y Manejo del recurso hídrico, 2021” según se detalla en los documentos UEN-PC-2021-00788 y PRE-2021-00650, sin embargo, a la fecha la municipalidad no ha brindado respuesta a las peticiones de información ni ha avanzado en los términos de referencia o en un proceso de licitación que le permita contar con el Plan Maestro del Acueducto de Paraíso, que responda a la sostenibilidad del acueducto en lo relativo a capacidad hídrica, hidráulica y financiera para los próximos 25 años, que incluya los 15 sistemas que lo conforman.

En el cantón de Paraíso, la Municipalidad recurrida es actualmente el operador del servicio de agua potable y saneamiento de aguas residuales, por ende, le corresponde además administrar, operar y mantener los servicios en buenas condiciones de funcionamiento. Por tal razón solo el operador del sistema puede dar un informe completo sobre las características y situación del acueducto que administran las áreas de cobertura. Respecto a lo indicado por el instituto recurrido se tiene que no se constata lesión alguna a los derechos fundamentales de la parte recurrente, dado que han realizado las gestiones pertinentes, y siendo que la municipalidad recurrida es la operadora del acueducto municipal, según el informe rendido, la misma indicó que el acueducto municipal, no opera en la totalidad del territorio del cantón, sino que hay lugares donde el suministro de agua potable dentro del cantón es brindado por asadas legalmente constituidas.

Ante la solicitud de agua potable por parte de la parte recurrente la Corporación Municipal, señaló que la municipalidad no puede dotarlo del recurso hídrico, debido a que no hay capacidad hídrica ni hidráulica. Esto debido a que cerca de las fincas no existen red ni nacientes concesionadas por la Municipalidad para dar el servicio que solicitan, siendo esto una imposibilidad técnica para brindar el servicio porque no se cuenta con infraestructura en la zona. Así las cosas, se tiene que pese a no existir gestión alguna pendiente de resolver, existe una imposibilidad material, científica y legal, concretamente; falta de capacidad hidráulica para dotar del servicio de agua potable a los recurrentes, por lo tanto, y de conformidad con los reiterados precedentes de esta Sala, lo correspondiente es declarar sin lugar el amparo, toda vez que la falta de dotación del servicio de agua potable está justificada puesto que impera una imposibilidad para proveer el servicio.

V.Si bien es cierto la dotación del servicio se limita por la problemática explicada en el Considerado anterior no menos cierto es que la comunidad afectada requiere del recurso hídrico mientras se busca una solución integral al problema. Por lo anterior deberán las autoridades municipales gestionar lo que corresponda a fin de garantizar el suministro de agua potable a la comunidad afectada mediante camiones cisterna u otra alternativa, a fin de que la población no se vea afectada.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes, que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del Despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara SIN LUGAR el recurso. Tomen notas las autoridades municipales del penúltimo Considerando de esta sentencia. Notifíquese.
