Decision No. 2024017915 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on veintiocho de junio de dos mil veinticuatro.
Writ of amparo (recurso de amparo) filed by [Nombre01 001], identity card [CED01], against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Background:
It is absurd, troubling, and suspicious that the Instituto Costarricense de Acueductos y Alcantarillados seeks to close a case concerning a problem that it itself acknowledges exists, for which it has failed to provide a definitive solution in 40 years, and regarding which all it has done is to present to your Honorable Chamber filings containing the same information, once again demonstrating that no progress whatsoever has been made on what it describes; this constitutes a clear evasion of action and responsibility. Accordingly, we request that your Honorable Chamber grant the appeal and order AYA to immediately implement a project that genuinely guarantees the permanent and equitable supply of potable water through the water-distribution system; this, in order to achieve a real rather than hypothetical solution.”

Considering:
I.Purpose of the action. The petitioner alleges that the area where she lives in Barrio San José de Alajuela, specifically Dirección01, is experiencing a shortage of potable water. She contends that, contrary to what the ICAA has reported, the area is not located on a mountain, is not an informal settlement (precario) or a pedestrian lane (alameda), but rather consists of homes belonging to owners who built them with the respective permits and who pay for public utilities on time. She states that the person in charge at the ICAA informed her that the problem is that there is no water; however—in her view—the respondent does not wish to distribute it equitably, since there are commercial establishments that do have that service. Moreover, the respondent institute discontinued the dispatch of water tanker trucks (camiones cisterna) to Dirección01; therefore, as of the date this action was filed, they had gone one week without water and four days without the dispatch of those tanker trucks, and they have not been provided with either a solution or an explanation for the problem. She requests that potable water service through the water mains be restored until the project for which that institute is responsible can be completed in 2027. She requests the intervention of the Chamber.
II.Proven facts. The following facts are deemed duly established and relevant to the determination of this matter, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:
III.Concerning the rationing of potable water service in the petitioner’s community. In judgment No. 2023008941 issued at 09:20 on 21 April 2023, this Chamber ruled on the water-shortage problem in the community of Dirección01 in San José de Alajuela and on the project that the ICAA is developing in that locality, holding, insofar as relevant:
“III.- Concerning the specific case. In the sub lite, the petitioner alleges that the community of Calle Moreira in San José de Alajuela has experienced water shortages for decades. He complains that, as a temporary measure, tanker trucks have been dispatched to refill the containers of the affected residents. He contends that the trucks appear unsanitary and that their operators do not ensure compliance with hygiene measures during distribution. He further states that the ICAA required each home to install a pipe to which the tanker truck could connect its hose to supply each home’s tanks, a measure he considers unfair because some residents lack the financial resources to construct such installations. He complains that the BCIE has provided funding to improve the water supply since 2012; however, there is no genuine solution to the problem presented.
Prima facie, it must be noted that the problem alleged by the petitioner regarding the water shortage in Barrio San José de Alajuela has come before this Chamber on several occasions.
Recently, in judgment no. 2022016425 issued at 9:20 on 15 July 2022, this Court held:
“III.- CONCERNING THE SPECIFIC CASE. In the sub examine, the applicant alleges that, since 2012, she has been monitoring an ICAA project that was purportedly intended to resolve the water shortage in the district of San José de Alajuela, specifically in Dirección01. She explains that no progress has been observed and that, on the contrary, water-shortage problems in the area worsen each day, while interruptions in the water supply are increasingly frequent and last longer, as occurred between 6 and 11 June 2022. She states that the ICAA reported that the project intended to resolve the alleged problem would not be completed until 2027. She requests that the ICAA provide a permanent solution to the problem affecting her community, particularly since the shortage is not as severe in neighboring areas. She maintains that dispatching tanker trucks carrying water as a temporary measure whenever water interruptions are detected has led the ICAA to use them more frequently, and she therefore questions the contract between that institute and the company that owns those trucks.
In this case, it has been established that the protected party (amparada) resides in San José de Alajuela. It has also been established that the first phase of the project “Mejoras al Sistema de Abastecimiento de Agua Potable El Pasito de Alajuela” was completed in August 2012. In that regard, the record states: “The scope of this project was principally to increase the water capacity of the Sistema El Pasito de Alajuela by drilling the wells now known as ‘Pozo Cacique 4’ and ‘Pozo Cacique 5,’ whose output is sent to the ‘tanque Cacique’ and subsequently pumped again through a 250mm HD (Ductile Iron) force main (línea de impulsión) to the tanque Borbón, which in turn supplies the areas of Villa Bonita, Montecillos, Dirección05 and Coyol de Alajuela.” The Chamber observes that, on 28 January 2014, an ICAA official sent emails to the protected party stating: “Good afternoon, Mrs. Mrs. (sic) Nombre02: The Proyecto de Mejoras al Pasito is the project that the AyA has undertaken to improve the Zona de Presión del Borbón, which includes the Sector de Barrio San José de Alajuela.
As previously indicated, all necessary actions are being taken so that the project may become operational as soon as possible.” The official also stated: “Good morning, Mrs. Nombre02. Attached is the response provided by Mr. Norman Artavia, who is responsible for the electromechanical component of the Región Central Oeste, explaining why the Proyecto de Mejoras has not yet become operational: Hello Nombre03. The aforementioned project has not (sic) become operational for the following reasons: The 500 Kvar Pad-Mounted Transformer has not been energized because it must be delivered to the ICE, together with the 300 Kvar transformer currently in operation. The latter has been operating for approximately 2.5 years. During an inspection performed by ICE technical personnel, they found certain (sic) internal deficiencies, and the procedures were therefore halted. Arrangements are being made to rent a transformer of the same type so that the 500 Kvar transformer may be energized and operational testing may be performed with the company INTEK.
Today, the information requested to proceed with the rental and installation of the equipment is being submitted at the Plantel La Maravilla del ICE. We are awaiting completion of the foregoing so that the Automatic Recloser and the 500 Kvar transformer may be officially accepted, leaving the repair or replacement of the 300 Kvar transformer pending. Note: This Unit is monitoring this matter in order to bring the project ‘Mejoras Pasito’ into operation. Kind regards.” It has likewise been established that the loan BCIE 2164 relating to project 001563 includes the project known as “Mejoras al Sistema El Pasito de Alajuela, Etapa II.” The works to be undertaken through that project are necessary to replace the existing pipelines in Dirección05; the project also provides for the construction of a 2600m3 storage tank. In addition, the Chamber finds that the ICAA provides potable water service in Barrio San José de Alajuela on an intermittent schedule between 6:00 and 23:00, which is why alternative means are used, such as dispatching tanker trucks between 7:00 and 14:00 from Monday through Sunday.
It has also been established that, on 4 June 2022, an ICAA official sent an email to other employees of that institute stating: “At approximately 17:00 on Saturday, 4 June 2022, multiple reports were received from high-elevation areas of Sistema CO-A-01 El Pasito de Alajuela, which are served by the Cacique-Borbón pressure zone through the tanks bearing those names. The reported localities included Villa Bonita, Lotes Solís, Dirección05 and El Coco (Santiago Oeste). Personnel from the electromechanical maintenance department proceeded to inspect the equipment and identified a failure in the equipment at Pozo Cacique 4 that prevented operations from being restarted; consequently, the equipment must be removed in order to pinpoint the cause of the detected failure. Until this water source (aprovechamiento) (COA01AP025) is brought back into operation, the Cacique-Borbón pressure zone of Sistema El Pasito de Alajuela has 24% less output (93 Liters per second).
Under these conditions, it is impossible to maintain the water level in tanque Cacique, either to serve the area supplied by that storage facility or to operate the Cacique-Borbón booster-pumping system, which directly affects the second storage facility and, of course, the aforementioned areas. Because of the foregoing and the weekend demand pattern, both tanks registered levels of 0.00 meters, a situation that remains virtually unchanged at this time (see the following image showing the level in tanque Borbón) and entails discontinuation of service in the indicated sectors, which will continue until the aforementioned water source is restored to operation (…) In view of the foregoing situation, overtime is hereby authorized for personnel from the Unidad Cantonal de Alajuela, who, beginning at 06:30 on Sunday, 5 June, will assist in supplying water through alternative means (tanker trucks).
Appropriate follow-up will be provided subject to the availability of the equipment essential for removing the equipment from Pozo Cacique 4.” Accordingly, the Court finds that, between 4 and 8 June 2022, Sistema CO-A-01 El Pasito experienced a technical and operational imbalance that caused interruptions in the provision of potable water service in the areas supplied by the Cacique and Borbón tanks, “which was caused by a sudden and unscheduled failure of the pumping equipment at the well known as Pozo Cacique 4, a water source that accounts for 24% of the potable water produced for human consumption by Sistema CO-A-01 El Pasito de Alajuela.” Consequently, the ICAA dispatched its own and rented tanker trucks to the affected areas in order to guarantee the minimum subsistence supply.
For his part, on June 13, 2022, the general manager of the ICAA informed the protected party (amparada) by email that: “(…) I confirm receipt of your email regarding the service deficiencies in Dirección01 in Alajuela. I would appreciate it if you would confirm the exact address of your residence or provide us with a service number (NIS) so that we can locate the site and analyze the problem affecting you. I also wish to inform you that the BCIE financing funds are being used for several dozen projects throughout the country, in places such as Sarapiquí, Puerto Viejo, Bagaces, Golfito, and others. Once we have confirmed your location, we could verify whether any of the investment projects include an improvement to the service at your place of residence. Unfortunately, we have had several incidents that have affected service in Barrio San José: failures at the Cacique well, damage caused by lightning last weekend, and even the fire at the cardboard factory, where large quantities of water were consumed, resulting in rationing.
I can confirm that we have no diversions to the Coyol free trade zone that affect residential service; those operations have been due to temporary and exceptional circumstances. Regarding new construction, its authorization or verification is not the responsibility of AyA; that is a municipal function. We will gladly proceed to investigate possible illegal connections and correct their impact on service availability. Finally, I requets [sic] that, if you would like us to contact you, please update your telephone number, as it is missing one digit (…)”.
In view of the foregoing, this Court considers it necessary to clarify that the problem alleged by the applicant (accionante), concerning the water shortage experienced by those residing in barrio San José de Alajuela, has been heard by this jurisdiction on several occasions. In that regard, in judgment No. 2022008784 at 9:20 a.m. on April 22, 2022, this Chamber ruled:
In the case at bar (sub lite), the petitioner (recurrente) alleges that the ICAA arbitrarily and unlawfully cuts off the water supply in barrio San José de Alajuela, with the result that, on most days, residents are without that service for more than 10 hours. She asserts that complaints have been filed for years; however, no effective solution has been implemented. She claims that the ICAA seeks to resolve the problem by dispatching tanker trucks, but they do not always arrive, with the result that the district is not fully served. She requests that the Instituto Costarricense de Acueductos y Alcantarillados make the investment necessary to supply water to the district of San José de Alajuela. She asks that, if the ICAA cannot provide them with water service, it be provided by another organization, such as the Municipalidad de Alajuela.
A review of the record shows that the petitioner is a resident of San José de Alajuela. It is also established that, since 2012, residents of San José de Alajuela have submitted various petitions to the Instituto Costarricense de Acueductos y Alcantarillados, the Municipalidad de Alajuela, and the Defensoría de los Habitantes de la República, to mention a few examples, concerning the problems relating to the provision of water service in that locality.
The Chamber notes that, on February 8, 2022, the Región Central Oeste of the ICAA issued memorandum SG-GSP-RC-2022-00091, which states: “SECOND: That the matters asserted by the petitioners in the filing admitted by the Sala Constitucional are confined to the geographical area known as Dirección06, also referred to as the Buenos Aires sector or ‘El Triángulo,’ an area in which this Region, within the jurisdiction of the Unidad Cantonal de Alajuela, has undertaken all actions necessary, within the scope of its operational authority and service provision, to guarantee this population’s access to drinking water; therefore, the assertion that the pipelines are completely devoid of this vital resource is untrue. On the contrary, the current situation corresponds to the factual circumstances supported by the technical and scientific information obtained by the Institute through automatic pressure recorders installed at the same monitoring points in the area (see Figure 1), which have previously been reported both to the Honorable Chamber and to the Defensoría de los Habitantes and which conclusively refute the assertion contained in the filing submitted by the petitioners (…) THIRD: That the relief requested by the petitioners from the Court is not only being provided by the Región Central Oeste in accordance with the judgment of the Sala Constitucional, but is also subject to strict periodic monitoring to determine whether the scheduling, deployment, and dispatch of alternative supply methods (tanker trucks) are warranted when interruptions in service exceed eight (8) hours.
This situation is shown in the charts for the aforementioned monitoring points (see Figure 2), which, for the 2022 dry season, have confirmed the continuing impact of hourly service interruptions in the following sectors: the upper portion of Dirección06 (Dirección07, ‘El Triángulo,’ or Buenos Aires), Dirección08 (upper sector of Fábrica de Tubos Campeón), and the upper sector of Dirección04. According to the records from monitoring points NIS 2001790, NIS 2000837, NIS 2001727, the interruption in those areas extends from 06:00 hours to 23:00 hours each day (see Figure 2) (…) FOURTH: That the chart presented in Figure 2 establishes that, except for these 3 upper sectors, the defined geographical area subject to periodic reviews does not experience service interruptions, although it clearly displays dynamic variation that decreases to below the minimum dynamic service-pressure threshold (10 m.c.a.), represented on the chart by the red horizontal line at the value of 10 on the vertical scale, as well as even below the functional service pressure (except for NIS 2001869), which corresponds to the red horizontal line positioned at the value of 7.5 on the vertical scale of the chart in Figure 2.
FIFTH: It is appropriate to inform the Honorable Chamber that the dynamic condition and behavior represented in the charts correspond to the normal dynamics of drinking-water distribution systems, since during daytime hours pressure decreases in direct relation to demand and consumption, while it increases during nighttime hours as a result of reduced consumption by the user population. Consequently, what is represented in the chart in Figure 2 is not attributable to any arbitrary action by the Institute, since actions and substantial efforts have been undertaken to date to maintain continuity of service through the aqueduct system, which, as previously reported in this particular case, depends on the so-called ‘Tanque Borbón.’ As shown in Figure 3, and unlike in previous years, that tank maintains an optimal storage level, as it generally remains at a depth of 3 meters, equivalent to a volume of one million two hundred thousand liters of water for human consumption (1 200m³).
Nevertheless, this is insufficient to guarantee uninterrupted service to all users in the area served by this tank, which is why alternative means (tanker trucks) are dispatched to assist the affected population, with emphasis on the aforementioned areas at higher elevations, where the piped supply is scarce and limited to seven (7) hours during the nighttime period (between 23:00 and 06:00 each day), as the petitioners partially state in their filing (…) SIXTH: It should be noted and reported to the Honorable Chamber that, in compliance with the requirements applicable to every public official under the principle of legality set forth in section 11 of the Constitución Política, as well as sections 11 and 16 of the Ley General de la Administración Pública, and with the express provisions of the Reglamento para la Prestación de los Servicios de AyA, Board of Directors Resolution N° 2020-442, published in Supplement N° 29 to the Diario Oficial La Gaceta N° 27 of Tuesday, February 9, 2021, within the scope of actions falling under the operational authority of the Región Central Oeste and the Unidad Cantonal de Alajuela, the sector supplied by the ‘Tanque Borbón’ is classified as a Deficit Area (Zona Deficitaria).
Accordingly, until the project known as Mejoras al Sistema El Pasito de Alajuela, Etapa II, included in BCIE Loan Agreement 2164, becomes operational, it is not possible to incorporate new urban-development, commercial, or real-estate projects (…) SEVENTH: Specifically, the timeframe for resolving the aforementioned technical insufficiency affecting the distribution networks in the barrio San José sector corresponds to the project previously identified to the Honorable Chamber, also referenced by the petitioners and known as ‘Mejoras al Sistema El Pasito de Alajuela, Etapa II,’ included in BCIE Loan Agreement 2164 and identified as project 001563 in the Banco de Proyectos de Inversión Pública (BPIP) of the Ministerio de Planificación y Política Económica (MIDEPLAN), whose progress is detailed in the attached schedule [see Anexo 1], dated December 2021. EIGHTH: That, in light of the technical aspects inherent in the operation of the pressure zone controlled by the ‘Tanque Borbón,’ which in turn is connected to the distribution networks extending to the barrio San José sector, and given that the Unidad Cantonal de Alajuela and the Región Central Oeste have available throughout the year—and more frequently during the dry season—the alternative means (tanker trucks) [see Anexo 2] necessary to serve the population of the barrio San José sector, including the petitioners, in accordance with the judgment of the Sala Constitucional.
NINTH: Additionally, it should be stated that, since February 1, 2021, billing adjustments have been applied to affected users in the Dirección06 sector (Dirección07, Buenos Aires, or ‘El Triángulo’) pursuant to section 95 of the Technical Regulations ‘Prestación de los Servicios de Acueducto y Alcantarillado Sanitario e Hidrantes, ARPSAYA-2013,’ published in Digital Supplement Nº 50 to La Gaceta Nº 186 of Monday, September 29, 2014, and its amendment, entitled ‘Reglamento Técnico Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes, AR-PSAYA-2015’ [See Anexo 3]. This adjustment also forms part of the actions undertaken by the Región Central Oeste in response to the problem described by the petitioners and is made under the grounds provided for in subsection a. of this section (…)” (emphasis added).
Whereas, on 7 de marzo de 2022, the ICAA’s Región Central Oeste issued memorandum SG-GSP-RC-2022-00162, which states: “(…) That the Unidad Cantonal de Alajuela and the Región Central Oeste, within the scope of their authority, have established and carried out ALL possible operational measures, as evidenced in report SG-GSP-RC-2022-00091 of 8 de febrero del 2022, which may be summarized as follows: 1. Implementation of an aggressive program to identify and eliminate non-visible leaks, the results of which are evident, since the so-called ‘Tanque Borbón’ maintains an optimal storage level (see Figure 3 of report SG-GSP-RC-2022-00091). This structure remains at a level of 3 meters in height, equivalent to a volume of one million two hundred thousand liters of water for human consumption (1 200m³), which, however, is insufficient to guarantee continuity of service for all users in the aforementioned sectors (…) It should be clarified that the preceding graph records minimum values (0,00mca) between 18:00 on viernes 17-feb-2022 and 19:00 on sábado 19-feb-2022, due to the failure of the motor at the so-called Pozo Juan León, which is why the aforementioned storage level was not maintained during this period. 2.
Deployment and dispatch of alternative means (tanker trucks) to assist the affected population experiencing service interruptions (discontinuidad) exceeding 8 hours per day, with emphasis on the aforementioned areas at higher elevations, where supply through the water-main system (cañería) is scarce and limited to seven (7) hours at night (between 23:00 and 06:00 each day, as shown by the green and yellow graph in Figure 3 of report SG-GSP-RC-2022-00091). 3. The Región Central Oeste and the Unidad Cantonal de Alajuela fully accepted the recommendation issued by Catalina Crespo Sancho, Ombudswoman for the Inhabitants (Defensora de los Habitantes), through official letter N° 09249-2020-DHR of miércoles 5 de agosto del 2020, in the so-called INFORME FINAL CON RECOMENDACIONES, concerning the SOLICITUD DE INTERVENCIÓN N° 308575-2020-SI-avh, which I quote: 1. Guarantee water tanker trucks for the community of Dirección06, also known as Dirección09, Dirección07, Barrio San José de Alajuela, whenever it experiences more than eight hours of water-service rationing (racionamiento del servicio de agua). 4.
To avoid degrading the service and increasing the periods of hourly interruption, as well as to prevent impairment of the rights of existing users—particularly those experiencing service interruptions and, even more so, in the circumstances and context affecting current users in barrio San José—the Unidad Cantonal de Alajuela and the Región Central Oeste issue denials of applications for potable-water service availability (disponibilidad de servicios de agua potable) that could potentially affect the sector in which the petitioners reside. This is also mandatory under the definitions included in the Reglamento para la Prestación de los Servicios de AyA, agreement of the Junta Directiva N° 2020-442, published in Alcance N° 29 of the Diario Oficial La Gaceta N° 27 of martes 9 de febrero del 2021 (…)”.
For its part, on 9 de marzo de 2022, the ICAA’s UEN Programación y Control issued report UEN-PC-2022-00494, detailing the background, actions completed, and actions pending to achieve implementation of the project “Mejoras al sistema de acueducto de El Pasito de Alajuela, Etapa II.” That document stated: “Phase 1: • El Erizo-INVU Las Cañas distribution network • Barrio San José distribution network • Lotes Solís distribution network • Replacement of the Puente Arena network • Equipping of the Coyol well, disinfection and electrification of the well site and Tanque El Coyol. • Tanque El Coyol 2600 m3 Phase 2: • Juan León well field (campo de pozos) • Juan León-Tanque Borbón transmission line (línea de conducción) • Force main (línea de impulsión) from a new well, to be determined, to Tanque El Coyol. • Juan León recharge tank (tanque de carga) 9m3 • Equipping of new well. Background Initially, in 2013, the feasibility study and design for the aforementioned project were developed through an external consultancy as part of the investment program known as BCIE 2164, for which the Institution was able to obtain financing for construction of the works through 2018.
The project’s supply sources depend on the drilling of wells. Accordingly, when the consultancy initially conducted the feasibility study and design, it identified a site known as Monterrocoso, where two wells were drilled in 2014, both to a depth of 150m. Subsequently, in 2016, pumping tests (pruebas de bombeo) were conducted under an external contract, and both wells yielded an insufficient flow rate (caudal) for development of the project: one well recorded a flow rate of 3 l/s and the other 10 l/s, whereas approximately 50-60 l/s is required from the two wells combined. In view of the foregoing, a new study had to be conducted in El Coyol to locate another site for drilling wells; this study was completed in 2018. However, because the recommendation of UEN Gestión Ambiental was that the wells be drilled to a depth of 250 m, an external contractor had to be engaged to drill them, since the Institution lacked the necessary equipment.
Consequently, a well was drilled in the El Coyol area in 2021, yielding a flow rate of 33 l/s. According to the recommendations of Gestión Ambiental, another well may not be drilled on this property; instead, another location was identified where a well must be drilled. Now, in 2015, the Juan León I well was drilled and yielded a flow rate of 102 l/s, but this well has a vertical-alignment problem. It is currently operating, and a maximum of approximately 70 l/s is extracted. With respect to this well field, in 2021 a well was drilled on the same property to replace the existing well and enable the extraction of at least 100 l/s from this well field. Due to the difficulties encountered in obtaining the flow rate required by the project to meet future demand, the decision was made in 2019 to divide the project into two stages so that the components that did not depend on land acquisition or well drilling could be implemented as soon as possible.
Thus, in agosto 2020, the Stage I design was submitted to the Región Central Oeste for review and approval of the plans, and a response was received in febrero 2021. Actions in progress The project has a preliminary design, which must be reviewed and updated. It is important to note that Phase 1 has acquired land and approved environmental feasibility (viabilidad ambiental). The design for Tanque El Coyol has been completed, while adjustments must be made to the distribution-network design due to changes requested by the Región Central Oeste. With respect to the El Coyol well, the design of the electromechanical equipment must be adjusted, and the disinfection system and electrification of the well site and Tanque El Coyol must be designed. With respect to Phase 2, the project has approved environmental feasibility, and the acquisition of only one property remains pending (Juan León well protection zone and access).
There is a preliminary design for the Juan León–Tanque Borbón transmission line and the Juan León recharge tank. The only pending items are the design of the Juan León well field, equipping the new well that must be drilled, and the corresponding force main from this well to Tanque El Coyol. Finally, according to the latest change request approved through GG-2022-00290, implementation of the project’s first phase would be completed in junio del año 2025 and the second phase in junio del año 2026. Memorandum GG-2022-00290, the processed change request, and the schedule are attached.” Meanwhile, on 10 de marzo de 2022, the ICAA’s Región Central Oeste issued memorandum SG-GSP-RC-2022-000181, in which it explained: “(…) It is imperative for this Dirección Regional to report that the Dirección de Operación y Mantenimiento de Sistemas de Agua Potable has established that, during the dry season (época de estiaje) (noviembre 2021 - mayo 2022), hourly interruptions and the resulting water shortage through the El Pasito de Alajuela water-supply system (acueducto) occur daily from 06:00 to 23:00, as stated in item THREE of response report (informe de descargo) SG-GSP-RC-2022-00091.
This Dirección takes note of the obligation imposed by the Sala Constitucional through decision N° 2022-004582 at 09:15 on 25 de febrero del 2022; accordingly, this schedule will be communicated to affected users. To that end, during the current month, printed flyers containing this information will be distributed, and the information will also be published through the institutional electronic media designated for this purpose, namely: Website Institutional website (www.aya.go.cr), in the section entitled Service Interruptions/Water Shortages, where users may consult the bulletins issued by the Institution regarding service disruptions. Additionally, as previously reported and as reiterated by the Honorable Chamber in its most recent decision N° 2022-004582 concerning this matter, the Unidad Cantonal de Alajuela continuously maintains distribution by means of tanker trucks (alternative means), an activity carried out from 07:00 to 14:00, Monday through Sunday.
These hours are also extended in force majeure (fuerza mayor) situations (such as the most recent event occurring between 17 and 19 de febrero del 2022) and, as previously indicated, this is mandatory pursuant to Judgment N° 2012-014247 at 9:05 on 12 de octubre de 2012 (…)” (boldface added).
In light of the foregoing, the Chamber considers it necessary to clarify that the issue alleged by the petitioner concerning the provision of potable-water service by the ICAA in San José de Alajuela has already been considered by this specialized jurisdiction. For example, judgment n.° 2012014247 at 9:05 on 12 de octubre de 2012 stated:
“IV.- RIGHT OF ACCESS TO POTABLE WATER. In repeated decisions, this Chamber has recognized a fundamental right to potable water. This was established in decision No. 2006-005606, at 15:21 hrs. on 26 de abril del 2006:
(«) VII.-Access to potable water as a human right. In addition to the foregoing—and perhaps the most relevant aspect of this matter—is the nature and function of water for human life. There is no need to explain here the evident and well-known fact that without water there can be neither life nor quality of life and that, therefore, with or without a nationalization law, by its very essence this matter is not, and cannot be, a territorial or local matter. The Chamber itself has held in its constitutional case law (jurisprudencia constitucional) that access to potable water is a fundamental human right because it forms part of the substance of the rights to health and life. (SALA CONSTITUCIONAL, judgments numbers 534-96, 2728-91, 3891-93, 1108-96, 2002-06157 2002-10776; 2004-1923). This same line of reasoning has been maintained in judgments 2003-04654 and 2004-07779, which, insofar as relevant, state:
V.The Chamber recognizes, as part of Constitutional Law (Derecho de la Constitución), a fundamental right (derecho fundamental) to drinking water (agua potable), derived from the fundamental rights to health, life, the environment, food, and adequate housing, among others, as has also been recognized in international human rights instruments applicable in Costa Rica: thus, it appears explicitly in the Convention on the Elimination of All Forms of Discrimination against Women (art. 14) and the Convention on the Rights of the Child (art. 24); it is also articulated in the Cairo International Conference on Population and Development (principle 2), and declared in numerous other instruments of International Humanitarian Law. Within our Inter-American Human Rights System, the country is particularly bound in this area by the provisions of article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (“Protocol of San Salvador of 1988), which provides: Article 11. Right to a healthy environment 1.-Everyone shall have the right to live in a healthy environment and to have access to basic public services. A lack of resources does not justify the failure of public administrations to fulfill their duties in providing this basic service. (SALA CONSTITUCIONAL, decisions 2003-04654 and 2004-007779).
Furthermore, as both the Procuraduría and the representative of AyA correctly acknowledge in their reports, internationally there is also broad recognition of water as a human right and as a necessary precondition for all our human rights. It is maintained that, without equitable access to a minimum amount of drinking water, other established rights—such as the right to a standard of living adequate for health and well-being, as well as other civil and political rights—would be unattainable. In November 2002, the United Nations Committee on Economic, Social and Cultural Rights affirmed that access to adequate quantities of clean water for domestic and personal use is a fundamental human right of every person. Likewise, in General Comment No. 15 on compliance with articles 11 and 12 of the International Covenant on Economic, Social and Cultural Rights, the Committee noted that “the human right to water is indispensable for leading a life in human dignity. It is a prerequisite for the realization of other human rights.” It also emphasized that the States Parties to the International Covenant have a duty to progressively fulfill, without discrimination of any kind, the right to water, which entitles everyone to sufficient, physically accessible, safe, and acceptable water for domestic and personal use.
Several international conferences have also been held, most notably the United Nations Water Conference held in Mar de Plata in 1977, which recognized that all peoples have the right of access to drinking water to meet their basic needs. The Declaration on the Right to Development, adopted by the UN General Assembly in 1986, also includes a commitment by States to ensure equal opportunities for all to enjoy basic resources.
The concept of meeting basic water needs was further strengthened during the 1992 Earth Summit in Río de Janeiro. In Agenda 21, governments agreed that “in developing and using water resources, priority must be given to meeting basic needs and safeguarding ecosystems.” Similarly, in the Plan of Implementation adopted at the Johannesburg Summit in 2002, governments committed to “employ all policy instruments, including regulation, monitoring... and recovery of the costs of water services,” without allowing cost-recovery objectives to become a barrier to poor people’s access to clean water. There are also dozens of international instruments directly and indirectly concerning water as a human right of all persons and peoples, such that, by its very nature, it is an issue tending not only toward the nationalization, but also toward the internationalization, of its use and exploitation (…) In addition to the foregoing, it must be taken into account that the General Assembly of the United Nations, through resolution No. A/64/L.63/Rev.1 of 26 de julio de 2010, declared (…) the right to drinking water and sanitation to be a human right essential to the full enjoyment of life and all human rights (…).”
In this matter, it has been fully and properly demonstrated that the community of Dirección10 faces serious problems with the continuity of its drinking-water supply. This follows both from the appellant’s statements and from the evidence submitted in the case record (autos). This Sala Constitucional acknowledges that the Instituto Costarricense de Acueductos y Alcantarillados is carrying out a project intended to remedy the problem at issue; nor does this Court overlook the various difficulties encountered in completing the works, which have required the schedules to be adjusted. Nevertheless, alternative and emergency measures to guarantee that the aforementioned community has access to this precious resource while the project is being completed are notably absent. In view of the circumstances described, this Sala Constitucional considers that the Instituto Costarricense de Acueductos y Alcantarillados was unquestionably required to put provisional measures in place to guarantee the community’s access to drinking water, such as the use of tanker trucks until more extensive measures can be implemented. In light of these considerations, this Sala Constitucional must intervene to restore the protected persons to the full enjoyment and exercise of their fundamental rights.
In view of the foregoing, the appeal must be granted, with the consequences specified in the operative portion (parte dispositiva) of this judgment.
POR TANTO:
The appeal is granted. Johnny Rodríguez Alvarado and Eduardo Lezama Fernández, in their respective capacities as Head of the Oficina Cantonal de Alajuela and Deputy General Manager, both of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever may hold those positions in their stead, are ordered to immediately carry out all actions falling within the scope of their authority so that the appropriate alternative and emergency measures are implemented to guarantee the community of Dirección05 access to drinking water until the projects devised by the entity are completed (…)” (boldface added).
Furthermore, in judgment n.° 2020003518 at 9:30 hours on 21 de febrero de 2020, this Chamber stated:
“IV.- Merits (fondo). In response to an amparo proceeding (amparo) filed in similar terms, this Chamber ruled in judgment n.° 2019008193 at 9:20 hours on 10 de mayo de 2019 as follows:
“CONCERNING DRINKING-WATER SERVICE. On repeated occasions, this Court has dismissed appeals such as the one before us because the area for which service is requested lies above the supply elevation (cota de abastecimiento)—that is, the maximum elevation at which service can be provided—or because of other technical impossibilities and objective constraints. Specifically with regard to supply problems, after recognizing that the provision of drinking water constitutes an essential, fee-based public service (servicio público esencial y oneroso), the Chamber’s case law has primarily sought to protect the rights to life and health of natural persons. Accordingly, guaranteeing the purity of water for human consumption and the continuity of its supply form part of the proper and efficient service owed to the customer (abonado) (see judgment Nº 004253-2014). Additionally, with respect to drinking-water supply problems, this Court has held that, insofar as the respondent authorities (autoridades recurridas) demonstrate that they have acted within their material capabilities to achieve an adequate supply, individuals’ fundamental rights are not violated if the service is provided with some irregularities in flow or supply hours (see, in this regard, this Chamber’s position in judgments Nº 2008-009714, 2008-018788, 2009-012511, 2010-015448 and 2011-006603, among others).” Later, that same judgment adds the following:
“The reports submitted by the respondent authorities, which are given under oath with the legal consequences that this entails, establish that the Hatillo de San José sector does indeed face a water-shortage problem, which has been aggravated by the considerable demand for drinking water and climatic conditions. From the foregoing, it is clear that the shortage alleged by the appellant in this matter is not the responsibility of the Instituto Costarricense de Acueductos y Alcantarillados, but rather results from climatic factors and from the failure of residents in the lower-lying areas of the sector referred to by the appellant to use water considerately.”
V.Specific case. In the present matter, the petitioner alleges a violation of the fundamental right of the residents of Barrio San José de Alajuela, in the sector known as El Triángulo, to access drinking water. The report submitted to this Chamber by the respondent authority, which was given under oath with the legal consequences that this entails, confirms that there is indeed a water-supply problem in the sector where the protected persons reside. In this case, the interruption of water service is due primarily to the topographic elevation of Buenos Aires, Barrio San José de Alajuela, where the protected persons reside, in relation to the Borbón tank, which is the AyA infrastructure serving that community. From the foregoing, it is clear that the water shortage alleged by the petitioner in this matter is attributable to the type of terrain on which the neighborhood is located, at an elevation higher than that of the supply tank, and is not attributable to inaction by the Instituto Costarricense de Acueductos y Alcantarillados, as the petitioner claims.
On the contrary, notwithstanding the situation described, it is apparent that the respondent authority has made significant efforts to remedy the problem, as was established. The Instituto is currently implementing a project involving improvements to the water system; and until those improvements are completed, which is scheduled for 2022, and the works associated with the Mejoras al Sistema El Patio de Alajuela, Etapa II project, included in the Préstamo BCIE 2164 agreement, become operational, AyA has arranged to assist residents in the higher parts of the locality through alternative measures (tanker trucks), which have already been implemented. As to the second issue raised by the petitioner, concerning the alleged failure to respond to complaints regarding the lack of water supply, the petitioner provides no evidence of any petition filed by any of the protected persons. In its response, AyA informed this Chamber under oath that the petition submitted in that regard is dated 01 de febrero de 2020, meaning that it was filed after this proceeding was instituted, and that it is being processed by the Dirección Regional de AyA.
In response to that petition, the respondent Instituto immediately called the interested parties to a meeting on miércoles 12 de febrero at 14:00 horas at the Sede Regional Central Oeste, Plantel Cacique, Alajuela, as evidenced by the email sent at 08:17 horas on lunes 03 de febrero de 2020 to the residents of Dirección05 de Alajuela. The report further indicates that, two days before this proceeding was instituted, by a memorandum filed on 27 de enero de 2020, the user associated with NIS [Valor 002], identified as [Nombre01 002], who is not a petitioner in this matter, reported a serious interruption of water service to AyA. According to the report submitted to this Chamber, the matter was addressed on 28 de enero de 2020 by the Región Central Oeste, which ordered the daily dispatch of tanker trucks to that sector, as provided for in the technical regulations. At the same time, service delivery was reassessed using automatic data loggers installed during the period from 28 de enero to 02 de febrero de 2020, the results of which showed interruptions in service between 07:00 and 16:00 horas, a period exceeding 8 hours per day without service; accordingly, the alternative supply by tanker trucks will be maintained.
Based on the foregoing, this Chamber rejects the alleged violation and finds that the Instituto Costarricense de Acueductos y Alcantarillados has processed the complaints submitted and has been making the necessary efforts to alleviate the water-shortage problem affecting this particular area. Consistent with the foregoing, there is no indication that it committed any omission causing the situation reported by the petitioner; the proceeding must therefore be dismissed in all respects, as is hereby ordered” (emphasis added).
Finally, and even more recently, the Court ruled on the aforementioned issue by issuing judgment n.° 2022004582 at 9:15 horas on 25 de febrero de 2022, which held:
“III.- REGARDING DRINKING-WATER SERVICE. On repeated occasions, this Court has dismissed proceedings such as the one before us because the area for which service is sought lies above the supply elevation threshold (cota de abastecimiento)—that is, the maximum elevation at which service can be provided—or because of other technical impossibilities and objective constraints. Specifically with respect to supply problems, after recognizing that the provision of drinking water constitutes an essential, fee-based public service, the Chamber’s case law has focused primarily on protecting the rights to life and health of natural persons (personas físicas). Thus, ensuring the purity of water for human consumption and continuity of its supply are components of proper and efficient service to the customer. Additionally, this Court has stated, in relation to drinking-water supply problems, that insofar as the respondent authorities demonstrate that they have acted within their material capabilities to achieve an adequate supply, the fundamental rights of individuals are not violated if service is provided with some irregularities in flow or supply schedules (see, to that effect, Judgment N° 2019-8193 at 9:20 horas on 10 de mayo de 2019).
In this case, first, it is stated under oath that the residents of Dirección11 de Alajuela have not remained without a drinking-water supply, but rather experience periods of dynamic pressure variation below the minimum pressure required to provide service with adequate quantity and continuity. It is further explained that the dynamic condition of drinking-water service in the area concerned by this proceeding corresponds to a natural pattern in the operation of drinking-water distribution systems: during daytime hours, pressure decreases as a direct consequence of high consumer demand, especially during the dry season, whereas pressure increases at night as a result of reduced consumption by the user population. In other words, it is clear that the supply problems in the area where the petitioners reside are attributable to technical impossibilities, and no arbitrary conduct by the Administration is evident.
Furthermore, regarding the specific actions undertaken to maintain continuity of service in the community of Dirección06 del barrio San José de Alajuela (also known as sector Buenos Aires or “El Triángulo” del Barrio San José de Alajuela), it was explained under oath that the following measures are being implemented: A) supplying drinking water by tanker trucks; B) implementing the “Mejoras al Sistema El Pasito de Alajuela, Etapa II” Project, which was included in the Préstamo BCIE 2164 agreement and designated as project 001563 in the Banco de Proyectos de Inversión Pública (BPIP) of the Ministerio de Planificación y Política Económica (MIDEPLAN), dated diciembre 2021, which finances the Programa de Abastecimiento del Área Metropolitana de San José Acueductos Urbanos II y Alcantarillado Sanitario de Juanito Mora de Puntarenas, entered into between BCIE and AyA on 04 de mayo de 2018 and expected to be completed in the fourth quarter of 2022; C) applying to residents of the sector the provisions of article 95 of the Reglamento Técnico: Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes, AR-PSAYA-2013 y su Reforma AR-PSAYA-2015, under which they are billed only the fixed drinking-water connection charge, and the affected residents are therefore billed for drinking-water consumption.
Regarding this issue—that is, the measures taken by the Administration to maintain continuity of service—this Constitutional Court has already found them sufficient to establish that the authorities were acting within their material capabilities to achieve an adequate supply. Thus, in the constitutional protection proceeding (recurso de amparo) processed under expediente N° 20-001681-0007-CO, the proceeding was dismissed by Judgment N° 2020-3518 at 9:30 horas on 21 de febrero de 2020, in accordance with the reasoning quoted below:
“V.- Specific case. In the present matter, the petitioner alleges a violation of the fundamental right of the residents of Barrio San José de Alajuela, in the sector known as El Triángulo, to access drinking water. The report submitted to this Chamber by the respondent authority, which was given under oath with the legal consequences that this entails, confirms that there is indeed a water-supply problem in the sector where the protected persons reside. In this case, the interruption of water service is due primarily to the topographic elevation of Buenos Aires, Barrio San José de Alajuela, where the protected persons reside, in relation to the Borbón tank, which is the AyA infrastructure serving that community. From the foregoing, it is clear that the water shortage alleged by the petitioner in this matter is attributable to the type of terrain on which the neighborhood is located, at an elevation higher than that of the supply tank, and is not attributable to inaction by the Instituto Costarricense de Acueductos y Alcantarillados, as the petitioner claims.
On the contrary, notwithstanding the situation described, it is apparent that the respondent authority has made significant efforts to remedy the problem, as was established. The Instituto is currently implementing a project involving improvements to the water system; and until those improvements are completed, which is scheduled for 2022, and the works associated with the Mejoras al Sistema El Patio de Alajuela, Etapa II project, included in the Préstamo BCIE 2164 agreement, become operational, AyA has arranged to assist residents in the higher parts of the locality through alternative measures (tanker trucks), which have already been implemented.
(…) Based on the foregoing, this Chamber rejects the alleged violation and finds that the Instituto Costarricense de Acueductos y Alcantarillados has processed the complaints submitted and has been making the necessary efforts to alleviate the water-shortage problem affecting this particular area. Consistent with the foregoing, there is no indication that it committed any omission causing the situation reported by the petitioner; the proceeding must therefore be dismissed in all respects, as is hereby ordered.” In light of the foregoing considerations, this Court finds that the respondent authority has not violated the petitioners’ right of access to drinking water and that the proceeding must therefore be dismissed, as is hereby ordered. Nevertheless, the respondent authority must take note of its obligation to communicate the periods during which water will be unavailable and to supply users with drinking water by tanker trucks until the works intended to provide a permanent solution to the situation have been definitively completed” (emphasis added).
Thus, contrary to the claims of the appellant, in the case under review (sub examine) it has not been established that the Instituto Costarricense de Acueductos y Alcantarillados makes arbitrary and unlawful interruptions to the water supply in San José de Alajuela; rather, as this Court stated in the aforementioned judgment no. 2012014247 at 9:05 a.m. on 12 de octubre de 2012, that locality experiences problems with the continuity of the drinking-water supply. This situation arises from “the topographical elevation of Buenos Aires, Dirección10, where the protected persons reside, in relation to the Borbón tank, which is the AyA infrastructure serving that community. From the foregoing, it is clear that the shortage alleged by the appellant in this matter is due to the type of terrain on which the neighborhood is located, at a level higher than the supply tank, and is not due to inaction by the Instituto Costarricense de Acueductos y Alcantarillados” (see judgment no. 2020003518 at 9:30 a.m. on 21 de febrero de 2020).
Moreover, it should be noted that the area experiences periods of dynamic variation, meaning that “during daytime hours, pressure decreases in direct relation to demand and consumption, whereas it increases during nighttime hours as a result of reduced consumption by the user population” (in this regard, see memorandum SG-GSP-RC-2022-00091 of 8 de febrero de 2022). Therefore, in the case before the Court (sub iudice), it has not been established that the alleged problem concerning the continuity of the drinking-water supply in San José de Alajuela is attributable to arbitrary conduct by ICAA, as alleged.
Having clarified the foregoing, as recorded in decisions nos. 2020003518 at 9:30 a.m. on 21 de febrero de 2020 and Telf04 at 9:15 a.m. on 25 de febrero de 2022, although the existence of the aforementioned supply problem has been established in this case, it is equally true that the record shows that ICAA has adopted various measures to provide both a permanent and a temporary solution to the situation. For example, the project “Improvements to the El Patio de Alajuela Water-Supply System, Phase II” (“Mejoras al sistema de acueducto de El Patio de Alajuela, Etapa II”) is being implemented, and assistance is being provided to the residents of San José de Alajuela through tanker trucks in an effort to maintain continuity in the provision of water service.
Consequently, the appeal cannot be granted on the terms in which it was filed. Nevertheless, the respondent authorities are hereby advised that they must undertake the necessary coordination and carry out all actions within the scope of their powers to guarantee the supply of drinking water to users in San José de Alajuela by means of tanker trucks until the works intended to provide a permanent solution to the problem alleged in the case under consideration (sub lite) have been fully completed” (emphasis added).
The precedents transcribed above apply to the case before the Court, since there are no grounds for departing from the criterion expressed therein or for assessing the situation presented differently. Accordingly, this Court has stated in several judgments that barrio San José de Alajuela experiences a problem with continuity in the provision of drinking-water service, owing to the topographical elevation of the locality relative to the location of the tank responsible for supplying water to the area. This Chamber has likewise deemed it established that the specified locality experiences periods of dynamic variation related to the level of water consumption during nighttime and daytime hours, resulting in changes in the capacity to supply that liquid. In addition, this Chamber has established that, in response to the problem described, the Instituto Costarricense de Acueductos y Alcantarillados has undertaken a series of actions intended to remedy the aforementioned shortage. These actions include the project “Improvements to the El Patio de Alajuela Water-Supply System, Phase II” (“Mejoras al sistema de acueducto de El Patio de Alajuela, Etapa II”), as well as the dispatch of tanker trucks to the affected communities in an effort to maintain continuity in the provision of the service.
Furthermore, with regard to the problem alleged by the appellant at the beginning of junio de 2022, this Court finds that, between 4 and 8 of that month, the CO-A-01 El Pasito system experienced a technical and operational imbalance that caused discontinuity in the provision of drinking-water service in the areas supplied by the Cacique and Borbón tanks, “which was caused by a sudden, unscheduled failure of the pumping equipment at the facility known as Dirección12, a source accounting for 24% of the drinking-water production for human consumption of the CO-A-01 El Pasito de Alajuela System.” Accordingly, ICAA dispatched its own and leased tanker trucks to the affected areas to guarantee a minimum subsistence supply.
Consequently, it has not been established in this case that the problem concerning the continuity of the drinking-water supply in San José de Alajuela is attributable to arbitrary conduct by ICAA; rather, the area has particular conditions relating to its topographical elevation and the population’s consumption. Furthermore, the discontinuity in the provision of that service between 4 and 8 de junio de 2022 was caused by a failure of the pumping equipment, and while it was being repaired, ICAA dispatched tanker trucks to the affected areas to guarantee a minimum subsistence supply.
Therefore, the appeal cannot be granted on the terms in which it was filed. The appellant is further advised that it is not for this Constitutional Court to assess, under the subconstitutional regulations governing the matter and the particular circumstances of the case under review, whether the measures adopted by ICAA to remedy the problem alleged in the case under consideration were appropriate, or to determine the specific actions that the institute must undertake to address the discontinuity of the drinking-water supply in San José de Alajuela.
Accordingly, the amparo proceeding (amparo) is denied. Nevertheless, the respondent authorities are hereby advised that they must undertake the necessary coordination and carry out all actions within the scope of their powers to guarantee the supply of drinking water to users in San José de Alajuela by means of tanker trucks until the works intended to provide a permanent solution to the problem alleged in the case under review have been fully completed.
IV.Finally, the petitioner is advised that it is not for this specialized jurisdiction to rule, under the subconstitutional regulations governing the matter and the particular circumstances of the case under review, on the objections raised by the appellant concerning the contract entered into between ICAA and the company that owns the tanker trucks used in the area where she resides. Accordingly, if the protected person so wishes, she may raise those objections before the respondent authority itself or through ordinary judicial proceedings.”
Consistent with the transcribed precedents, in the case under consideration the appellant expresses disagreement with the actions of the Instituto Costarricense de Acueductos y Alcantarillados concerning the water shortage in San José de Alajuela. Specifically, he claims: 1) that no effective solution has been found to the problem presented; 2) that the tanker trucks and the officials distributing the water do not comply with hygiene standards; and 3) that the respondent institute intends for residents to install a water intake to supply the tanks, even though they lack the financial means to do so.
Regarding the first issue, this Chamber finds that, although the ICAA authorities have not guaranteed a permanent solution to the water-shortage problem in San José de Alajuela, this is not attributable to arbitrary decisions by the institute. This is so because, as this Chamber found in the cited precedents, that locality experiences problems with the continuity of the drinking-water supply arising from “the topographical elevation of Buenos Aires, Dirección10, where the protected persons reside, in relation to the Borbón tank, which is the AyA infrastructure serving that community. From the foregoing, it is clear that the shortage alleged by the appellant in this matter is due to the type of terrain on which the neighborhood is located, at a level higher than the supply tank, and is not due to inaction by the Instituto Costarricense de Acueductos y Alcantarillados” (see, to the same effect, judgment no. 2020003518 at 9:30 a.m. on 21 de febrero de 2020).
It is likewise established that ICAA has adopted a series of measures to provide solutions to the situation described. For example, the project “Improvements to the Pasito de Alajuela Water-Supply System” (“Mejoras al sistema de acueducto de Pasito de Alajuela”) is in the implementation phase, and drinking water is being supplied provisionally by tanker trucks.
Regarding the second issue, concerning hygiene in the supply of water by tanker trucks, the respondent authorities deny the allegations and state that “the water transported in the tanker trucks is one hundred percent potable, in accordance with the quality standard required of the tanker-truck companies hired by AyA.” They also attach the water-quality reports issued by the Laboratorio Nacional de Aguas.
In this regard, it must be noted that determining whether the hygiene measures followed in water-supply operations are optimal falls outside the authority of this Chamber in summary amparo proceedings. Likewise, this Chamber must not act as a forum for processing complaints; accordingly, the complaint concerning the workers’ attire, the cleanliness of the truck, the manner in which the hose is handled, and the officials’ alleged smoking must be raised—if the appellant so wishes—before the respondent authority itself or through ordinary judicial proceedings.
Finally, with regard to the complaint concerning the obligation to construct a water intake to fill the tank at each house, the report submitted under oath shows that this notice was rescinded before the filing of this amparo, as a result of the meeting held on 31 de enero de 2023 among representatives of Dirección10, the general manager, and officials from the technical division of ICAA’s Región Central Oeste.
Therefore, on the terms in which the amparo was filed, no constitutionally significant acts or omissions by the respondent authorities have been established.
Consequently, the amparo appeal must be denied, but not without first advising the ICAA authorities that they must continue carrying out all actions within the scope of their powers to guarantee the supply of drinking water to users in San José de Alajuela by means of tanker trucks, in due compliance with hygiene standards, until the works intended to provide a permanent solution to the water-shortage problem in the affected area have been completed.”
IV.Regarding the specific case. In the present matter, after analyzing the evidence (elementos probatorios) submitted and the reports rendered under oath by the respondent authorities (autoridades recurridas) of the Instituto Costarricense de Acueductos y Alcantarillados, with the consequences, including criminal consequences, provided for in Article 44 of the Ley de Jurisdicción Constitucional, it is deemed established that the appellant (recurrente) is a resident of Dirección01, in Dirección10. It is also established that, as of the date the appeal was filed, namely, 04 de abril de 2024, she had been without water service for four days; and although the respondent authority reports that water is distributed by tanker trucks, the fact remains that it states that this is done by alternating among the communities, every other day, and that during each visit the internal storage tanks belonging to residents of the area are filled.
Accordingly, it is established that although the appellant’s community lacked water service for four days, delivery by tanker trucks is not carried out daily, which means that the shortage of drinking water lasted longer than eight hours. Thus, it is confirmed that the Instituto Costarricense de Acueductos y Alcantarillados has violated the appellant’s fundamental rights (derechos fundamentales), since it has not taken the measures necessary to guarantee continuity of drinking-water service and, when rationing (racionamientos) has been implemented, it has neither established nor complied with a clear, predetermined schedule, nor arranged for delivery by tanker trucks according to schedules that were likewise established in advance. Consequently, the appeal is granted, with the consequences set forth in the operative part (parte dispositiva) of this judgment.
V.Documents submitted to the case file (expediente). The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Sesión No. 27-11, del 22 de agosto del 2011, Article XXVI, and published in the Boletín Judicial No. 19, del 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial in Sesión No. 43-12, celebrada el 3 de mayo del 2012, Article LXXXI.
Por tanto:
The appeal is granted. Juan Manuel Quesada Espinoza, in his capacity as Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that office in his stead, is ordered to issue the pertinent directives and carry out all actions within the scope of his authority so that: a) immediately upon notification of this judgment, a clearly defined schedule is established and implemented should it be necessary to continue rationing drinking water in the community of Dirección01 in Barrio San José de Alajuela; and b) immediately, through some temporary alternative, a sufficient daily supply of drinking water is guaranteed to meet the population’s basic needs whenever service is interrupted for periods exceeding eight hours. The respondent, or whoever holds that office, is warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding (recurso de amparo), which he or she is required to comply with or enforce, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) in the contentious-administrative jurisdiction (vía contencioso-administrativa). Let notice be given.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veintiocho de junio de dos mil veinticuatro .
Recurso de amparo promovido por [Nombre01 001], cédula de identidad [CED01], contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
Redacta el Magistrado Garita Navarro; y,
Considerando:
I.Objeto del recurso. La recurrente alega en la zona donde vive en el Barrio San José de Alajuela, específicamente Dirección01, enfrenta problemas de faltante de agua potable. Aduce que, contrario a lo que el ICAA ha informado, tal zona no está ubicada en una montaña, no es un precario ni una alameda, sino que son casas de propietarios que construyeron con los permisos respectivos, que pagan los servicios públicos puntualmente. Afirma que la persona encargada en el ICAA le informó que el problema es que no hay agua; empero -a su juicio- la recurrida no quiere distribuirla de manera equitativa, dado que hay locales comerciales que sí cuentan con ese servicio. Además, el instituto recurrido eliminó el envío de los camiones cisterna a Dirección01, por lo que, a la fecha de interposición de este recurso, cumplen una semana sin agua y cuatro días sin el envío de dichas cisternas y tampoco se le brinda una solución o explicación a la problemática. Requiere que se restablezca el servicio de agua potable por medio de cañerías hasta que se logre realizar el proyecto que se encuentra a cargo de dicho instituto en el 2027. Solicita la intervención de la Sala.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
III.Sobre los racionamientos en el servicio de agua potable en la comunidad de la recurrente. Esta Sala mediante sentencia No. 2023008941 de las 09:20 horas del 21 de abril de 2023, se pronunció sobre el problema de desabastecimiento de agua en la comunidad de Dirección01 en San José de Alajuela y el proyecto que se encentra desarrollando el ICAA en esa localidad, disponiéndose en lo que interesa:
“III.- Sobre el caso concreto. En el sub lite, el recurrente acusa que desde hace décadas la comunidad de Calle Moreira en San José de Alajuela sufre problemas de desabastecimiento de agua. Reclama que, como medida paliativa, han enviado camiones cisterna para rellenar los recipientes de los vecinos afectados. Aduce que los camiones lucen desaseados y los operarios no garantizan las medidas de higiene durante la repartición. Además, afirma que el ICAA exigió que cada casa instale un tubo para que el camió cisterna conecte la manguera para abastecer los tanques de cada casa, medida que estima injusta, pues algunos vecinos no cuentan con los recursos económicos para construir dichas instalaciones. Reclama que desde el 2012 el BCIE otorgó los recursos económicos para mejorar el abastecimiento de agua; empero, no existe una solución real a la problemática presentada.
Prima facie, debe advertirse que la problemática acusada por el recurrente en relación con el desabastecimiento de agua en barrio San José de Alajuela ha sido objeto de conocimiento de esta Sala en varias ocasiones.
Recientemente, en la sentencia nro. 2022016425 de las 9:20 horas del 15 de julio de 2022, este Tribunal dispuso:
“III.- SOBRE EL CASO CONCRETO. En el sub examine, la parte accionante acusa que desde el año 2012 le ha dado seguimiento a un proyecto del ICAA que presuntamente solucionaría el desabastecimiento de agua en el distrito de San José de Alajuela, propiamente, en Dirección01. Detalla que no se ha constatado avance alguno y que, por el contrario, cada día en la zona se dan más problemas de desabastecimiento de agua y los cortes del líquido son más frecuentes y se prolongan por más tiempo, como el acaecido entre el 6 y el 11 de junio de 2022. Expone que el ICAA informó que el proyecto para solventar la problemática acusada se estaría concretando hasta el año 2027. Solicita que el ICAA brinde una solución permanente al problema que aqueja a su comunidad, máxime que, en zonas aledañas, el desabastecimiento no es tan severo. Sostiene que el envío de camiones cisterna con agua como medida paliativa cuando se detecten cortes de agua ha hecho que el ICAA los emplee con más frecuencia, por lo que cuestiona el contrato entre ese instituto y la empresa dueña de esos camiones.
En la especie se acredita que la amparada reside en San José de Alajuela. Además, se constata que en agosto de 2012 se concluyó la primera etapa del proyecto “Mejoras al Sistema de Abastecimiento de Agua Potable El Pasito de Alajuela”. Al respecto, se observa que “ El alcance de este proyecto, principalmente, fue el de aumentar la capacidad hídrica del Sistema El Pasito de Alajuela, esto por medio de la perforación de los pozos que hoy se conocen como “Pozo Cacique 4” y “Pozo Cacique 5”, cuya producción se envía al “tanque Cacique” para posteriormente ser rebombeados a través de una línea de impulsión de 250mm HD (Hierro Dúctil) hasta el tanque Borbón y este a su vez abastece las zonas de Villa Bonita, Montecillos, Dirección05 y Coyol de Alajuela”.
La Sala observa que, el 28 de enero de 2014, un funcionario del ICAA remitió correos electrónicos a la tutelada en los que señaló: “Buenas tardes doña doña (sic) Nombre02: El Proyecto de Mejoras al Pasito, es el Proyecto que ti ene el AyA, para mejorar la Zona de Presión del Borbón, dentro de la cual se encuentra el Sector de Barrio San José de Alajuela. Como se indicó anteriormente se está realizando todas las acciones necesarias, para que dicho Proyecto entre en operación en el menor tiempo posible”. Así como: “Buenos días doña Nombre02, adjunto respuesta que nos dio el Sr. Norman Artavia, encargado de la parte electromecánica de la Región Central Oeste, donde indica los motivos por lo cual el Proyecto de Mejoras, a la fecha no se puesto en operación: Buenas Nombre03 El proyecto citado no se a (sic) puesto en operación por lo siguiente: No se ha energizado el Transformador de Pedestal de 500 Kvar, debido a que el mismo se debe de entregar al ICE y también el transformador en operación de 300 Kvar.
Este tiene aproximadamente 2.5 años de estar en operación. En inspección realizada por personal Técnico del ICE, encontraron alguna (sic) deficiencias internas por lo que se detuvieron los trámites. Se está realizando trámite de alquiler de un transformador de este mismo tipo, para poder energizar el transformador de 500 Kvar y proceder a realizar las pruebas de operación con la empresa INTEK. Hoy se está presentando en el Plantel La Maravilla del ICE, la información solicitada para proceder a ejecutar el alquiler y la instalación del equipo. Estamos en espera de la ejecución de lo anterior, para que sea recibido Oficialmente el Recloser Automático y el transformador de 500 Kvar y dejar pendiente la reparación o sustitución del transformador de 300 Kvar. Nota: esta Unidad le está dando seguimiento a este asunto, para poner en operación el proyecto "Mejoras Pasito". Saludos, atentamente”.
Asimismo, se comprueba que, por medio del empréstito BCIE 2164 referido al proyecto 001563 se incluye la denominada “Mejoras al Sistema El Pasito de Alajuela, Etapa II ”. Las obras a desarrollar a través de ese proyecto son necesarias para la sustitución de las tuberías existentes en el Dirección05; además, se pretende construir un tanque de almacenamiento de 2600m3. Adicionalmente, la Sala verifica que en el barrio San José de Alajuela la prestación del servicio de agua potable por parte del ICAA se da con discontinuidad horaria entre las 6:00 y las 23:00 horas, motivo por el cual se emplean medios alternativos, como el envío de camiones cisternas, entre las 7:00 y las 14:00 horas de lunes a domingo.
Igualmente, se acredita que, el 4 de junio de 2022, un funcionario del ICAA envió un correo electrónico a otras personas servidoras de ese instituto en el que se indicó: “Aproximadamente a las 17:00 horas del sábado 4 de junio del 2022 se reciben múltiples reportes de zonas altas del Sistema CO-A-01 El Pasito de Alajuela, las cuales son atendidas por la zona de presión Cacique - Borbón, por medio de los tanques homónimos y registrándose dentro de estos reportes a las localidades de Villa Bonita, Lotes Solís, Dirección05 y El Coco (Santiago Oeste). Los funcionarios del área de mantenimiento electromecánico proceden con la revisión de los equipos, identificándose una falla en el equipo del pozo Cacique 4, el cual imposibilita reiniciar su operación y motivo por el cual debe extraerse el equipamiento para ubicar específicamente lo referido a la falla detectada. Hasta la puesta en operación nuevamente de este aprovechamiento (COA01AP025) la zona de presión Cacique - Borbón del Sistema El Pasito de Alajuela se encuentra con un 24% menos de producción (93 Litros por segundo) y en esta condición es imposible mantener el nivel de tanque Cacique, tanto para atender la zona que abastece este almacenamiento, como también para operar el rebombeo Cacique - Borbón, aspecto que incide directamente en el segundo almacenamiento y por supuesto en las zonas antes señaladas.
Debido a lo anterior y al patrón de demanda del fi n de semana, ambos tanques registraron niveles 0,00 metros, situación que prácticamente se mantiene invariable a esta hora (ver siguiente imagen del nivel de tanque Borbón) y que supone la discontinuidad del servicio en los sectores indicados, la cual será extensivo hasta la puesta en funcionamiento del mencionado aprovechamiento (…) Debido a la situación señalada, se procede con la autorización de tiempo extraordinario para los compañeros de la Unidad Cantonal de Alajuela que a partir de las 06:30 horas del domingo 5 de junio apoyarán el suministro de agua por medio alternativo (camiones cisterna). Se brindará el seguimiento correspondiente conforme la disponibilidad de equipo imprescindible para extraer el equipamiento del pozo Cacique 4”.
Así las cosas, el Tribunal acredita que, entre el 4 y el 8 de junio de 2022, el sistema CO-A-01 El Pasito experimentó una descompensación técnico-operativa que generó discontinuidad en la prestación del servicio de agua potable en las zonas abastecidas por los tanques Cacique y Borbón “ lo cual fue motivado por un fallo súbito y no programado en el equipo de bombeo del denominado pozo Cacique 4, aprovechamiento que supone el 24% de la producción de agua potable para consumo humano del Sistema CO-A-01 El Pasito de Alajuela”. Por lo anterior, el ICAA remitió a las zonas afectadas camiones cisternas propios y alquilados, a fin de garantizar la dotación mínima de subsistencia.
Por su parte, el 13 de junio de 2022, el gerente general del ICAA le comunicó vía correo electrónico a la amparada que: “(…) Le confirmo el recibido de su correo respecto a las deficiencias del servicio en Dirección01 en Alajuela. Le agradecería nos confirme una dirección exacta del lugar de su residencia, o que nos suministre un numero de servicio (NIS) para ubicar el sitio y realizar el análisis de la problemática que le aqueja. Así mismo, le manifiesto que los fondos de financiamiento del BCIE se están ejecutando en varias decenas de proyectos en todo el país, en lugares como Sarapiquí, Puerto Viejo, Bagaces, Golfito, y otros. Una vez que hayamos confirmado su ubicación podríamos verificar si alguno de los proyectos de inversión incluye una mejora al servicio en su lugar de residencia. Lamentablemente hemos tenido varios incidentes que han afectado el servicio en Barrio San José: fallas en el pozo del Cacique, daños por rayería el fin de semana pasado, incluso por el incendio de la cartonera, consumieron grandes cantidades a agua que produjeron racionamiento.
Si le puedo confirmar que no tenemos desvíos a la zona franca Coyol que afecte el servicio residencial, esas operaciones se han debido a condiciones temporales y excepcionales. Respecto a las nuevas construcciones, la autorización o verificación de las mismas no corresponde al AyA, esa es una función municipal. Si con gusto procederemos con la revisión a las posibles conexiones ilegales y corregir el impacto en la disponibilidad del servicio. Finalmente, le isolicito (sic) que si desea nos comuniquemos con su persona, por favor se sirva actualizar su número de teléfono pues le falta un dígito (…)”.
En virtud de lo expuesto, este Tribunal considera necesario aclarar que la problemática acusada por la accionante atinente al desabastecimiento de agua aquejado por quienes residen en barrio San José de Alajuela ha sido objeto de conocimiento de esta jurisdicción en diversas ocasiones. En ese sentido, en la sentencia n.° 2022008784 de las 9:20 horas del 22 de abril de 2022, esta Cámara dispuso:
En el sub lite, la recurrente acusa que el ICAA realiza cortes arbitrarios e ilegales del suministro de agua en el barrio San José de Alajuela, por lo que la mayoría de días no cuentan con tal servicio durante más de 10 horas. Alega que durante años se han interpuesto quejas; empero, no se ha ejecutado alguna solución efectiva. Aduce que el ICAA pretende resolver el problema a través del envío de camiones cisterna, pero no siempre llegan, lo que ocasiona que el distrito no quede totalmente cubierto. Solicita que el Instituto Costarricense de Acueductos y Alcantarillados efectúe la inversión necesaria para abastecer al distrito de San José de Alajuela de agua. Pide que, en caso de que el ICAA no les pueda proporcionar el servicio de agua, este sea brindado por otra organización como la Municipalidad de Alajuela.
Del estudio de los autos se desprende que la recurrente es vecina de San José de Alajuela. Además, se constata que, desde el año 2012, vecinos de San José de Alajuela han planteado diversas gestiones ante el Instituto Costarricense de Acueductos y Alcantarillados, la Municipalidad de Alajuela y la Defensoría de los Habitantes de la República, por mencionar algunos ejemplos, concernientes a la problemática relativa a la prestación del servicio de agua en tal localidad.
La Sala observa que, el 8 de febrero de 2022, la Región Central Oeste del ICAA emitió el memorando SG-GSP-RC-2022-00091, por medio del cual se consigna: “ SEGUNDO: Que lo señalado por los recurrentes mediante escrito de interposición admitido por la Sala Constitucional se circunscribe al área geográfica de la denominada Dirección06, también referido al sector Buenos Aires o “El Triángulo”, zona donde esta Región, en la jurisdicción de la Unidad Cantonal de Alajuela, ha mantenido todas las actuaciones, dentro del ámbito de competencia operativa y prestación de servicio, necesarias para garantizar el acceso al agua potable de esta población, siendo por tanto que la afirmación referida a la ausencia absoluta del vital líquido en las tuberías no se ajusta a la verdad y por el contrario, la realidad actual corresponde al cuadro fáctico que se sustenta la información técnica y científica que obtiene el Instituto mediante registradores de presión automáticos que se disponen en los mismos puntos de control en la zona (ver Figura
Mientras que, el 7 de marzo de 2022, la Región Central Oeste del ICAA emitió el memorando SG-GSP-RC-2022-00162, en el que se indica: “(…) Que la Unidad Cantonal de Alajuela y la Región Central Oeste, dentro del ámbito de sus competencias, han establecido y desarrollado TODAS las actuaciones operativas posibles, lo cual se encuentra patente en el informe SG-GSP-RC-2022-00091 del pasado 8 de febrero del 2022 y que pueden ser resumidas en los siguientes aspectos: 1. Implementación de un agresivo programa de identificación y eliminación de fugas no visibles cuyo resultado es evidente, toda vez que el denominado “Tanque Borbón” mantiene un nivel óptimo de almacenamiento (ver Figura 3 del informe SG-GSP-RC-2022-00091), estructura que permanece con un nivel de 3 metros de altura, lo que equivale a un volumen de un millón doscientos mil litros de agua para consumo humano (1 200m³), lo cual sin embargo, resulta insuficiente para garantizar la continuidad para todos los usuarios en los sectores supra citados (…) Conviene aclarar que en el gráfico anterior se registran valores mínimos (0,00mca) entre las 18:00 del viernes 17-feb-2022 hasta las 19:00 del sábado 19-feb-2022, esto debido al fallo del motor del denominado Pozo Juan León y motivo por el cual en este periodo no se mantuvo el nivel de almacenamiento antes señalado. 2.
Disposición y envío de medios alternativos (camiones cisterna) para asistir a la población afectada con un periodo de discontinuidad superior a las 8 horas diarias, con énfasis en las zonas topográficamente más elevadas antes citadas, donde el suministro por cañería es escaso y limitado a siete (7) horas en periodo nocturno (entre las 23:00 y 06:00 de cada día conforme lo muestra la gráfica color verde y amarillo de la Figura 3 del informe SG-GSP-RC-2022-00091). 3. La Región Central Oeste y la Unidad Cantonal de Alajuela acogió en todos sus extremos la recomendación emitida por la señora Catalina Crespo Sancho, Defensora de los Habitantes, mediante oficio N° 09249-2020-DHR del miércoles 5 de agosto del 2020 en el denominado INFORME FINAL CON RECOMENDACIONES, relacionado con la SOLICITUD DE INTERVENCIÓN N° 308575-2020-SI-avh, cito: 1. Garantizar a la comunidad de Dirección06, misma que se conoce como Dirección09, Dirección07, Barrio San José de Alajuela, camiones cisternas de agua en el momento en que sufran de más de las ocho horas de racionamiento del servicio de agua. 4.
Con el objetivo de no desmejorar el servicio y acrecentar los periodos de discontinuidad horaria, así como también para no generar menoscabo en los derechos de los usuarios existentes, con especial relevancia de aquellos que aquejan discontinuidad del servicio y más aún en el escenario y coyuntura que refiere a la situación que aqueja a los actuales usuarios del barrio San José, la Unidad Cantonal de Alajuela y la Región Central Oeste emiten resoluciones negativas por solicitudes de disponibilidad de servicios de agua potable que tengan potencial incidencia en el sector donde habitan los recurrentes, lo cual además resulta insoslayable conforme a las propias definiciones incorporadas en el Reglamento para la Prestación de los Servicios de AyA, acuerdo de Junta Directiva N° 2020-442, publicado en el Alcance N° 29 al Diario Oficial La Gaceta N° 27 del martes 9 de febrero del 2021 (…)”.
Por su parte, el 9 de marzo de 2022, la UEN Programación y Control del ICAA emitió el informe UEN-PC-2022-00494, por medio del que se detalló lo concerniente a los antecedentes, acciones realizadas y pendientes para lograr la ejecución del proyecto “Mejoras al sistema de acueducto de El Pasito de Alajuela, Etapa II”. En tal memorial se consignó: “ Fase 1: • Red de distribución El Erizo-INVU Las Cañas • Red de distribución Barrio San José • Red de distribución Lotes Solís • Sustitución red Puente Arena • Equipamiento de pozo Coyol, desinfección y electrificación sitio pozo y Tanque El Coyol. • Tanque El Coyol 2600 m3 Fase 2: • Campo pozos Juan León • Línea conducción Juan León-Tanque Borbón • Línea impulsión pozo nuevo por definir a Tanque El Coyol. • Tanque de carga Juan León 9m3 • Equipamiento pozo nuevo. Antecedentes En primera instancia, en el año 2013 se desarrolla la factibilidad y diseño del proyecto indicado anteriormente, estudios que fueron desarrollados por medio de consultoría externa como parte del programa de inversión denominado BCIE 2164, para el cual la Institución pudo obtener financiamiento para la ejecución de las obras hasta el año 2018.
Las fuentes de abastecimiento para el proyecto dependen de la perforación de pozos, es por esto que, inicialmente cuando la consultoría realizó la factibilidad y diseño, localizó un sitio denominado Monterrocoso, en el cual se ejecutó la perforación de dos pozos en el año 2014, ambos con una profundidad de 150m. Posteriormente, en el año 2016 se llevaron a cabo las pruebas de bombeo mediante una contratación externa, y en ambos se obtuvo un caudal insuficiente para el desarrollo del proyecto, ya que; se registró un caudal de 3 l/s para uno de los pozos y de 10 l/s para el otro, cuando lo que se requiere es de unos 50-60 l/s entre los dos pozos. Dado lo anterior, en la localidad de El Coyol se debió realizar nuevamente un estudio para localizar otro sitio para perforar pozos, el cual estuvo terminado en el año 2018. Pero, debido a que la recomendación de la UEN Gestión Ambiental fue que los pozos debían perforarse a 250 m de profundidad, se tuvo que realizar una contratación externa para perforarlos, ya que la Institución no contaba con el equipo necesario.
Es entonces que, se perforó un pozo en la zona de El Coyol en el año 2021, para el cual se obtuvo un caudal de 33 l/s y según las recomendaciones de Gestión Ambiental, no se puede perforar otro pozo en el este terreno, sino que se localizó otro lugar en el que se debe perforar un pozo. Ahora bien, en el año 2015 se perforó el pozo Juan León I para el cual se obtuvo un caudal de 102 l/s, pero este pozo presenta un problema de verticalidad, actualmente se encuentra en operación y se extraen máximo unos 70 l/s. Con respecto a este campo de pozos, en el año 2021 se perforó un pozo en esta misma propiedad, con el fin de sustituir el pozo existente y poder extraer al menos 100 l/s en este campo de pozos. Debido a las complicaciones que se han tenido con la obtención del caudal requerido por el proyecto para abastecer la demanda futura, en el año 2019 se tomó la decisión de dividir el proyecto en dos etapas, con el fin de ejecutar a la brevedad posible los componentes que no dependen de terrenos y que no dependían de la perforación de pozos.
Es así que, en agosto 2020 se entrega el diseño de la etapa I a la Región Central Oeste para la revisión de planos y su aprobación, obteniendo respuesta en febrero 2021. Acciones en proceso El proyecto cuenta con un diseño preliminar, el cual debe ser revisado y actualizado. Es importante mencionar que, la fase 1 tiene terrenos adquiridos y viabilidad ambiental aprobada. Se encuentra finalizado el diseño de Tanque El Coyol, y en el diseño de redes de distribución se deben realizar ajustes debido a la petición de cambios por parte de la Región Central Oeste. Con respecto al pozo El Coyol, se debe ajustar el diseño del equipo electromecánico, diseñar la desinfección y la electrificación del sitio de pozo y Tanque El Coyol. Ahora bien, con respecto a la fase 2, el proyecto tiene viabilidad ambiental aprobada y se encuentra pendiente la adquisición de sólo un terreno (zona de protección y acceso pozo Juan León).
Se tiene un diseño preliminar de línea de conducción Juan León – Tanque Borbón y tanque de carga Juan León, solamente se encuentra pendiente el diseño de campo de pozos Juan León, equipamiento de pozo nuevo que se requiere perforar y la correspondiente línea de impulsión desde este pozo al Tanque El Coyol. Finalmente, según la última solicitud de cambio aprobada mediante GG-2022-00290, el proyecto finalizaría su ejecución de la primera fase en junio del año 2025 y la segunda fase en junio del año 2026. Se adjunta memorando GG-2022-00290, solicitud de cambio tramitada y cronograma”.
En tanto que, el 10 de marzo de 2022, la Región Central Oeste del ICAA emitió el memorando SG-GSP-RC-2022-000181, en el que detalló: “(…) Resulta imperativo para esta Dirección Regional informar que la Dirección de Operación y Mantenimiento de Sistemas de Agua Potable tiene por acreditado que durante la época de estiaje (noviembre 2021 - mayo 2022) la discontinuidad horaria y en consecuencia el desabastecimiento por medio del acueducto El Pasito de Alajuela, se presenta de forma diaria desde las 06:00 hasta las 23:00 horas, tal como fue manifestado en el punto TERCERO del informe de descargo SG-GSP-RC-2022-00091. Toma nota esta Dirección sobre la obligación señalada por la Sala Constitucional mediante resolución N° 2022-004582 de las 09:15 del 25 de febrero del 2022, motivo por el cual este horario será comunicado a los usuarios afectados, acción para la cual, durante el mes en curso se entregarán los volantes físicos con esta información, así como también será publicada en los medios electrónicos institucionales dispuestos para este efecto, a saber: Página Web Sitio web institucional (www.aya.go.cr), en la sección denominada Interrupciones de Servicio/ Faltantes de Agua, donde los usuarios pueden consultar los boletines emitidos por la Institución por afectación del servicio.
Adicionalmente, como ya ha sido previamente informado y reitera la Honorable Sala en su más reciente resolución N° 2022-004582 respecto a este particular, la Unidad Cantonal de Alajuela mantiene la distribución por medio de camiones cisterna (medios alternativos) de forma continua, actividad que se desarrolla desde las 07:00 a las 14:00 horas, de lunes a domingo, horario que además se extiende ante situaciones de fuerza mayor (tal como la última acaecida entre el 17 y 19 de febrero del 2022) y que, como también ha sido indicado con anterioridad, resulta ineludible conforme la Sentencia N° 2012-014247 de las 9:05 horas de 12 de octubre de 2012 (…)” (la negrita fue agregada).
En virtud de lo expuesto, la Sala estima menester aclarar que la problemática acusada por la parte accionante concerniente a la prestación del servicio de agua potable por parte del ICAA en San José de Alajuela ha sido objeto de conocimiento de esta jurisdicción especializada. Verbigracia, en la sentencia n.° 2012014247 de las 9:05 horas del 12 de octubre de 2012 , se indicó:
“IV.- DERECHO DE ACCESO AL AGUA POTABLE . En reiteradas resoluciones esta Sala ha reconocido un derecho fundamental al agua potable. Así se dispuso en la resolución No. 2006-005606, de las 15:21 hrs. de 26 de abril del 2006:
(«) VII.-El acceso al agua potable como derecho humano. Adicionalmente a lo señalado, y talvez el aspecto más relevante en este tema, lo constituye la naturaleza y función del agua para la vida humana. No es necesario detallar aquí una explicación sobre la realidad evidente y notoria de que sin agua no puede haber vida, ni calidad de vida, y que por lo tanto, con ley o sin ley de nacionalización, por su propia esencia, este tema, no es ni puede ser un tema territorial o local. La propia Sala en su jurisprudencia constitucional ha dicho que el acceso al agua potable es un derecho humano fundamental, en cuanto se configura como un integrante del contenido del derecho a la salud y a la vida. (SALA CONSTITUCIONAL, sentencias números 534-96, 2728-91, 3891-93, 1108-96, 2002-06157 2002-10776; 2004-1923). Esta misma línea se ha mantenido en las sentencias 2003-04654 y 2004-07779, que en lo que interesa señalan:
V.La Sala reconoce, como parte del Derecho de la Constitución, un derecho fundamental al agua potable, derivado de los derechos fundamentales a la salud, la vida, al medio ambiente, a la alimentación y la vivienda digna, entre otros, tal como ha sido reconocido también en instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica: así, figura explícitamente en la Convención sobre la Eliminación de todas las formas de discriminación contra la mujer (art. 14) y la Convención sobre los Derechos del Niño (art. 24); además, se enuncia en la Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2), y se declara en otros numerosos del Derecho Internacional Humanitario. En nuestro Sistema Interamericano de Derechos Humanos, el país se encuentra particularmente obligado en esta materia por lo dispuesto en el artículo 11.1 del Protocolo Adicional a la Convención Americana sobre Derechos en Materia de Derechos Económicos, Sociales y Culturales (³Protocolo de San Salvador de 1988), el cual dispone que: Artículo 11.
Derecho a un medio ambiente sano 1.-Toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos. La carencia de recursos no justifica el incumplimiento de los cometidos de las administraciones públicas en la prestación de este servicio básico. (SALA CONSTITUCIONAL, resoluciones 2003-04654 y 2004-007779).
Por su parte, como bien lo reconocen tanto la Procuraduría como el representante del AyA en sus informes, en el campo internacional también es mayoritario el reconocimiento del agua como derecho humano y como una pre-condición necesaria para todos nuestros derechos humanos. Se sostiene que sin el acceso equitativo a un requerimiento mínimo de agua potable, serían inalcanzables otros derechos establecidos -como el derecho a un nivel de vida adecuado para la salud y para el bienestar, así como de otros derechos civiles y políticos. En noviembre del 2002, el Comité de Derechos Económicos, Sociales y Culturales de las Naciones Unidas afirmó que el acceso a cantidades adecuadas de agua limpia para uso doméstico y personal es un derecho humano fundamental de toda persona. Asimismo en el Comentario General No. 15 sobre el cumplimiento de los artículos 11 y 12 del Pacto Internacional de Derechos Económicos, Sociales y Culturales, el Comité hizo notar que µel derecho humano al agua es indispensable para llevar una vida en dignidad humana.
Es un pre-requisito para la realización de otros derechos humanos. Se enfatiza también que los Estados miembros del Pacto Internacional tienen el deber de cumplir de manera progresiva, sin discriminación alguna, el derecho al agua, el cual da derecho a todos a gozar de agua suficiente, físicamente accesible, segura y aceptable para uso doméstico y personal.
Por su parte se han dado varias conferencias internacionales entre las que destaca la Conferencia de las Naciones Unidas sobre el Agua llevada a cabo en Mar de Plata en 1977 que reconoció que todos los pueblos tienen derecho al acceso a agua potable para satisfacer sus necesidades básicas. También, la Declaración sobre el Derecho al Desarrollo, adoptada por la Asamblea General de la ONU, de 1986 incluye un compromiso por parte de los Estados de asegurar la igualdad de oportunidades para todos para disfrutar de los recursos básicos.
El concepto de satisfacer las necesidades básicas de agua se fortaleció más durante la Cumbre de la Tierra de 1992 en Río de Janeiro. En la Agenda 21, los gobiernos acordaron que µal desarrollar y usar los recursos hídricos, debe darse prioridad a la satisfacción de las necesidades básicas y a la conservación de los ecosistemas. De igual forma, en el Plan de Implementación adoptado en la Cumbre de Johannesburgo en el 2002, los gobiernos se comprometieron a µemplear todos los instrumentos de políticas, incluyendo la regulación, el monitoreo... y la recuperación de costos de los servicios de agua, ¶sin que los objetivos de recuperación de costos se conviertan en una barrera para el acceso de la gente pobre al agua limpia. Asimismo existen decenas de instrumentos internacionales que directa e indirectamente tienen que ver con el agua como un derecho humano de todas las personas y pueblos, de tal forma que no sólo es un tema que por su naturaleza tiende a la nacionalización, sino a la internacionalización de su uso y aprovechamiento («) Aunado a lo anterior, debe tomarse en cuenta que la Asamblea General de la Organización de las Naciones Unidas, por medio de la resolución No. A/64/L.63/Rev.1 de 26 de julio de 2010, declaró («) el derecho al agua potable y el saneamiento como un derecho humano esencial para el pleno disfrute de la vida y de todos los derechos humanos («)´.
En este asunto está plena e idóneamente demostrado que en la comunidad de Dirección10, se presentan serios problemas en la continuidad del suministro de agua potable. Lo anterior se desprende, tanto del dicho de la recurrente, como de la prueba aportada a los autos. Esta Sala Constitucional reconoce que el Instituto Costarricense de Acueductos y Alcantarillados está ejecutando un proyecto con el fin de solventar la problemática en cuestión; tampoco obvia este Tribunal que se han enfrentado inconvenientes varios para culminar las obras, lo que ha obligado a una readecuación de los cronogramas. Sin embargo, se echa de menos la ejecución de medidas alternativas y de emergencia, para garantizar el acceso de la comunidad citada, al preciado líquido, mientras el proyecto se finaliza. Atendiendo a las circunstancias expuestas, estima esta Sala Constitucional que, sin lugar a dudas, le es exigible al Instituto Costarricense de Acueductos y Alcantarillados, haber dispuesto medidas provisionales para garantizar el acceso de la comunidad al agua potable como por ejemplo, la utilización de camiones cisterna hasta tanto se puedan poner en marcha medidas de mayor envergadura. Bajo este orden de consideraciones, esta Sala Constitucional debe intervenir, con el propósito de restablecer a los tutelados, en el pleno goce y ejercicio de sus derechos fundamentales.
En mérito de lo expuesto, se impone declarar con lugar el recurso, con las consecuencias que se particularizan en la parte dispositiva de esta sentencia.
POR TANTO:
Se declara con lugar el recurso. Se ordena a Johnny Rodríguez Alvarado y a Eduardo Lezama Fernández, en sus calidades respectivas de Jefe de la Oficina Cantonal de Alajuela y Subgerente General, ambos del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes en sus lugares ocupen esos cargos, que, de manera inmediata, lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que se ejecuten las medidas alternativas y de emergencia pertinentes, con el fin de garantizar el acceso al agua potable, de la comunidad de Dirección05, en tanto se culminan los proyectos ideados por la entidad (…) ” (la negrita fue agregada).
Por su parte, en la sentencia n.° 2020003518 de las 9:30 horas del 21 de febrero de 2020, esta Cámara señaló:
“IV.- Sobre el fondo. Ante un amparo planteado en términos similares, esta Sala se pronunció en sentencia n.° 2019008193 de las 9:20 horas del 10 de mayo de 2019, en los siguientes términos:
“SOBRE EL SERVICIO DE AGUA POTABLE . En reiteradas ocasiones este Tribunal ha desestimado recursos como el que nos ocupa, debido a que la zona en la que se reclama el servicio supera la cota de abastecimiento -es decir, la altura máxima para otorgar el servicio-, o a otras imposibilidades técnicas y presupuestos objetivos. Concretamente en cuanto a problemas de abastecimiento, tras reconocer que el suministro de agua potable constituye un servicio público esencial y oneroso; la jurisprudencia de la Sala se ha dirigido fundamentalmente a la protección del derecho a la vida y a la salud de las personas físicas. Así, garantizar la pureza del líquido para consumo humano y la continuidad en el suministro de éste forman parte de un debido y eficiente servicio al abonado (véase la sentencia Nº 004253-2014). Adicionalmente, este Tribunal ha indicado, en relación con los problemas de abastecimiento de agua potable, que en el tanto las autoridades recurridas demuestren que se ha actuado dentro de sus posibilidades materiales a fin de lograr un adecuado abastecimiento, no se quebrantarían los derechos fundamentales de las personas si éste se ofrece con algunas irregularidades de caudal, u horario de suministro (ver, al respecto, el criterio de esta Sala en las sentencias Nº 2008-009714, 2008-018788, 2009-012511, 2010-015448 y 2011-006603, entre otras).” Más adelante, agrega esa misma sentencia lo siguiente:
“De los informes rendidos por las autoridades recurridas los cuales son dados bajo la solemnidad del juramento con las consecuencias legales que ello implica se verifica que efectivamente en el sector de Hatillo de San José, existe un problema de desabastecimiento de agua, que se ha agravado por la considerable demanda de agua potable y la situación climática. De lo expuesto, es claro que el desabastecimiento acusado por la recurrente en este asunto no es responsabilidad del Instituto Costarricense de Acueductos y Alcantarillados, sino de factores climáticos y de falta de consideración del uso del agua de los habitantes es las zonas más bajas del sector al que se refiere el recurrente”.
V.Caso concreto. En el presente asunto, el recurrente reclama la vulneración del derecho fundamental de acceso al agua potable de los vecinos de Barrio San José de Alajuela, en el sector conocido como el Triángulo. Del informe rendido ante esta Sala por la autoridad recurrida, el cual es dado bajo juramento con las consecuencias legales que ello implica, se verifica que efectivamente en el sector donde residen los tutelados, existe un problema de abastecimiento de agua. En este caso, la discontinuidad del servicio de agua se debe principalmente a la elevación topográfica del lugar Buenos Aires, Barrio San José de Alajuela, donde habitan los tutelados, en relación con el tanque Borbón, que es la infraestructura del AyA que atiende a esa comunidad. De lo expuesto, es claro que el desabastecimiento acusado por la parte recurrente en este asunto se debe al tipo de superficie donde está ubicado el barrio, que está a un nivel alto y más elevado del tanque de abastecimiento y no se debe a inercia del Instituto Costarricense de Acueductos y Alcantarillados como describe el recurrente.
Por el contrario, pese a la situación descrita, se aprecia que la autoridad recurrida ha realizado importantes esfuerzos para remediar la problemática, según se tuvo por acreditado. En la actualidad, se está implementado un proyecto por parte del Instituto que corresponde a las mejoras al sistema de agua; y mientras no se concluyan, lo que se tiene previsto para el año 2022, y entren en operación tales obras -asociadas al proyecto Mejoras al Sistema El Patio de Alajuela, Etapa II, incorporadas en el contrato de Préstamo BCIE 2164-, el AyA ha previsto dar asistencia a los vecinos de las partes altas de la localidad con medidas alternativas (camiones cisterna) lo que se ha venido implementando. En cuanto al segundo aspecto que reclama la parte recurrente, y que tiene que ver con la supuesta falta de respuesta a las denuncias planteadas por la falta del suministro de agua, este no aporta ninguna gestión presentada por parte de alguno de los amparados, En su respuesta, el AyA informa bajo la gravedad de juramento ante esta Sala que la gestión planteada en ese sentido es de fecha 01 de febrero de 2020, lo que significa que fue presentada en fecha posterior a la interposición de este recurso, y está siendo tramitada por la Dirección Regional de AyA.
En atención a la misma, el instituto recurrido de inmediato convocó a las partes interesadas a una reunión el miércoles 12 de febrero a las 14:00 horas en la Sede Regional Central Oeste, Plantel Cacique, Alajuela, lo que se desprende del correo electrónico de las 08:17 horas del lunes 03 de febrero de 2020, dirigido a los vecinos de Dirección05 de Alajuela. Se desprende además del informe que, dos días antes de interponerse el presente recurso, por nota presentada el 27 de enero de 2020, la usuaria del NIS [Valor 002] identificada como [Nombre01 002], que no es recurrente en este asunto, reportó al AyA una discontinuidad grave en el servicio de agua, lo que, según el informe dado a esta Sala fue atendido el 28 de enero de 2020 por la Región Central Oeste que dispuso el envío diario de camiones cisterna a ese sector, tal como se encuentra previsto en la normativa técnica, al tiempo que también se revaloró la prestación del servicio, a partir de los registradores automáticos instalados en el periodo comprendido entre el 28 de enero y 02 de febrero de 2020, cuyos resultados evidenciaron discontinuidad de servicio entre las 07:00 y 16:00 horas, periodo que supera las 8 horas diarias sin servicio, razón por la que se mantendrá el abastecimiento por medio alternativo de camiones cisterna.
De lo anteriormente expuesto, esta Sala descarta la violación acusada y considera que el Instituto Costarricense de Acueductos y Alcantarillados ha dado trámite a las quejas planteadas y ha venido realizando los esfuerzos necesarios para paliar el problema de falta de agua que afecta la zona en particular. Consecuente con lo anterior, no se desprende que haya incurrido en alguna omisión que provoque la situación que denuncia la parte recurrente, por lo que procede desestimar el recurso en todos sus extremos, como en efecto se dispone” (el resaltado fue incorporado).
Finalmente, de forma todavía más reciente, el Tribunal se pronunció sobre la referida problemática, dado que emitió la sentencia n.° 2022004582 de las 9:15 horas del 25 de febrero de 2022, en la que se dispuso:
“III.- SOBRE EL SERVICIO DE AGUA POTABLE. En reiteradas ocasiones este Tribunal ha desestimado recursos como el que nos ocupa, debido a que la zona en la que se reclama el servicio supera la cota de abastecimiento -es decir, la altura máxima para otorgar el servicio-, o a otras imposibilidades técnicas y presupuestos objetivos. Concretamente en cuanto a problemas de abastecimiento, tras reconocer que el suministro de agua potable constituye un servicio público esencial y oneroso; la jurisprudencia de la Sala se ha dirigido fundamentalmente a la protección del derecho a la vida y a la salud de las personas físicas. Así, garantizar la pureza del líquido para consumo humano y la continuidad en el suministro de éste forman parte de un debido y eficiente servicio al abonado. Adicionalmente, este Tribunal ha indicado, en relación con los problemas de abastecimiento de agua potable, que en el tanto las autoridades recurridas demuestren que se ha actuado dentro de sus posibilidades materiales a fin de lograr un adecuado abastecimiento, no se quebrantarían los derechos fundamentales de las personas si éste se ofrece con algunas irregularidades de caudal, u horario de suministro (véase en ese sentido la Sentencia N° 2019-8193 de las 9:20 horas del 10 de mayo de 2019).
En este caso, en primer lugar, se asegura bajo juramento que los vecinos de Dirección11 de Alajuela no han permanecido sin abastecimiento de agua potable, sino que registran periodos de variación dinámica de presión por debajo del límite de la presión mínima requerida para brindar servicio con cantidad y continuidad. Además, se explica que la condición dinámica del servicio de agua potable en la zona objeto de este recurso, corresponde a un hábito natural de la dinámica que refiere a los sistemas de distribución de agua potable, siendo que en el horario diurno, la presión decrece como consecuencia directa de la alta demanda de consumo de los usuarios, sobre todo en época de verano, mientras que la presión aumenta en el horario nocturno como efecto de la reducción del consumo por parte de la población usuaria. Es decir, resulta claro que los problemas de abastecimiento en la zona que habitan los recurrentes obedecen a imposibilidades técnicas, por lo que no se observa un actuar arbitrario de la Administración.
Por otra parte, en cuanto a las acciones concretas para procurar mantener la continuidad del servicio, en la comunidad de Dirección06 del barrio San José de Alajuela (también conocida como sector Buenos Aires o “El Triángulo” del Barrio San José de Alajuela), bajo juramento se explicó que se desarrollan las siguientes: A) abastecimiento de agua potable por medio de camiones cisterna; B) se está implementando el Proyecto “Mejoras al Sistema El Pasito de Alajuela, Etapa II” , el cual fue incorporado en el contrato de Préstamo BCIE 2164 y referido al proyecto 001563 del Banco de Proyectos de Inversión Pública (BPIP), del Ministerio de Planificación y Política Económica (MIDEPLAN), que data de diciembre 2021, y que financia el Programa de Abastecimiento del Área Metropolitana de San José Acueductos Urbanos II y Alcantarillado Sanitario de Juanito Mora de Puntarenas, suscrito entre el BCIE y el AyA el 04 de mayo de 2018 y que se estima culminar en el cuarto trimestre del año 2022; C ) se les aplica a los vecinos del sector, los alcances del artículo 95, del Reglamento Técnico: Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes, AR-PSAYA-2013 y su Reforma AR-PSAYA-2015, por lo que solo se les factura el cargo fijo de conexión de agua potable, por lo que se les factura a los afectados consumos de agua potable.
En cuanto a este extremo, es decir, las medidas tomadas por la Administración para mantener la continuidad del servicio, ya este Tribunal Constitucional consideró que eran suficientes para considerar que estaban actuando dentro de sus posibilidades materiales a fin de lograr un adecuado abastecimiento. Así, en el recurso de amparo que se tramitó bajo el expediente N° 20-001681-0007-CO, se declaró sin lugar el recurso por Sentencia N° 2020-3518 de las 9:30 horas de 21 de febrero de 2020, de conformidad con los razonamientos que se citan a continuación:
“V.- Caso concreto. En el presente asunto, el recurrente reclama la vulneración del derecho fundamental de acceso al agua potable de los vecinos de Barrio San José de Alajuela, en el sector conocido como el Triángulo. Del informe rendido ante esta Sala por la autoridad recurrida, el cual es dado bajo juramento con las consecuencias legales que ello implica, se verifica que efectivamente en el sector donde residen los tutelados, existe un problema de abastecimiento de agua. En este caso, la discontinuidad del servicio de agua se debe principalmente a la elevación topográfica del lugar Buenos Aires, Barrio San José de Alajuela, donde habitan los tutelados, en relación con el tanque Borbón, que es la infraestructura del AyA que atiende a esa comunidad. De lo expuesto, es claro que el desabastecimiento acusado por la parte recurrente en este asunto se debe al tipo de superficie donde está ubicado el barrio, que está a un nivel alto y más elevado del tanque de abastecimiento y no se debe a inercia del Instituto Costarricense de Acueductos y Alcantarillados como describe el recurrente.
Por el contrario, pese a la situación descrita, se aprecia que la autoridad recurrida ha realizado importantes esfuerzos para remediar la problemática, según se tuvo por acreditado. En la actualidad, se está implementado un proyecto por parte del Instituto que corresponde a las mejoras al sistema de agua; y mientras no se concluyan, lo que se tiene previsto para el año 2022, y entren en operación tales obras -asociadas al proyecto Mejoras al Sistema El Patio de Alajuela, Etapa II, incorporadas en el contrato de Préstamo BCIE 2164-, el AyA ha previsto dar asistencia a los vecinos de las partes altas de la localidad con medidas alternativas (camiones cisterna) lo que se ha venido implementando.
(…) De lo anteriormente expuesto, esta Sala descarta la violación acusada y considera que el Instituto Costarricense de Acueductos y Alcantarillados ha dado trámite a las quejas planteadas y ha venido realizando los esfuerzos necesarios para paliar el problema de falta de agua que afecta la zona en particular. Consecuente con lo anterior, no se desprende que haya incurrido en alguna omisión que provoque la situación que denuncia la parte recurrente, por lo que procede desestimar el recurso en todos sus extremos, como en efecto se dispone”.
En atención a las consideraciones expuestas, considera este Tribunal que la autoridad recurrida no ha vulnerado el derecho de acceso al agua potable de los recurrentes y, en consecuencia, corresponde desestimar el recurso, como en efecto se dispone. No obstante, debe tomar nota la autoridad recurrida su obligación de comunicar los horarios de desabastecimiento y de abastecer a los usuarios de agua potable por medio de camiones cisterna, hasta tanto no se ejecuten en forma definitiva los trabajos que procuran solucionar en forma definitiva la situación” (el énfasis fue añadido).
De este modo, contrario a lo alegado por la parte recurrente, en el sub examine no se verifica que el Instituto Costarricense de Acueductos y Alcantarillados realice cortes arbitrarios e ilegales en el suministro de agua en San José de Alajuela, sino que, tal como lo indicó este Tribunal en la supramencionada sentencia n.° 2012014247 de las 9:05 horas del 12 de octubre de 2012, en esa localidad existen problemas en la continuidad del suministro de agua potable. Tal situación deriva de “la elevación topográfica del lugar Buenos Aires, Dirección10, donde habitan los tutelados, en relación con el tanque Borbón, que es la infraestructura del AyA que atiende a esa comunidad. De lo expuesto, es claro que el desabastecimiento acusado por la parte recurrente en este asunto se debe al tipo de superficie donde está ubicado el barrio, que está a un nivel alto y más elevado del tanque de abastecimiento y no se debe a inercia del Instituto Costarricense de Acueductos y Alcantarillados” (véase la sentencia n.° 2020003518 de las 9:30 horas del 21 de febrero de 2020).
Aunado a lo anterior, nótese que en tal zona existen periodos de variación dinámica que implican que “en el horario diurno la presión decrece como relación directa de la demanda y consumo mientras que aumenta en el horario nocturno como efecto de la reducción del consumo por parte de la población usuaria” (al respecto ver memorando SG-GSP-RC-2022-00091 del 8 de febrero de 2022). Ergo, en el sub iudice no se tiene por comprobado que la problemática acusada relativa a la continuidad del suministro de agua potable en San José de Alajuela se deba a una actuación arbitraria por parte del ICAA en los términos acusados.
Aclarado lo anterior, tal como se consignó en los pronunciamientos n. os 2020003518 de las 9:30 horas del 21 de febrero de 2020 y Telf04 de las 9:15 horas del 25 de febrero de 2022, si bien en la especie se verifica la existencia del referido problema de suministro, no menos cierto es que de los autos se desprende que el ICAA ha adoptado diversas medidas para dar una solución tanto definitiva como temporal a tal situación. Verbigracia, se encuentra en ejecución el proyecto “Mejoras al sistema de acueducto de El Patio de Alajuela, Etapa II”, así como se brinda asistencia a los vecinos de San José de Alajuela por medio de camiones cisternas, a fin de procurar mantener la continuidad en la prestación del servicio de agua.
En consecuencia, no procede acoger el recurso en los términos en los que fue formulado. Sin embargo, tomen nota las autoridades recurridas que deberán coordinar lo necesario y llevar a cabo todas las actuaciones que estén dentro del ámbito de sus competencias, a fin de garantizar el abastecimiento de agua potable a los usuarios de San José de Alajuela mediante camiones cisternas, hasta tanto se no culminen definitivamente las obras que pretenden dar una solución definitiva a la problemática acusada en el sub lite” (el destacado fue agregado).
Los precedentes transcritos resultan aplicables al sub iudice, dado que no se encuentran motivos para variar el criterio vertido, ni motivos para valorar de manera diferente la situación planteada. Así las cosas, este Tribunal ha indicado en varias sentencias que en barrio San José de Alajuela existe un problema de continuidad en el suministro del servicio de agua potable, lo cual obedece a la elevación topográfica del lugar en relación con la ubicación del tanque encargado de proporcionar agua a tal zona. Asimismo, esta Cámara ha tenido por demostrado que en el lugar señalado existen periodos de variación dinámica, lo cual tiene relación con el nivel de consumo de agua en horario nocturno y diurno, lo que genera cambios en la capacidad de proporcionar el referido líquido. Adicionalmente, esta Sala ha acreditado que, ante la problemática descrita, el Instituto Costarricense de Acueductos y Alcantarillados ha llevado a cabo una serie de acciones, a fin de solventar el referido desabastecimiento. Entre tales acciones se encuentran el proyecto “Mejoras al sistema de acueducto de El Patio de Alajuela, Etapa II ”, así como el envío de camiones cisternas a las comunidades afectadas, a los efectos de procurar mantener la continuidad en la prestación del servicio.
Aunado a lo anterior, en cuanto al problema acusado por la recurrente acontecido a inicios de junio de 2022, este Tribunal verifica que, entre el 4 y el 8 de ese mes, el sistema CO-A-01 El Pasito experimentó una descompensación técnico-operativa que causó discontinuidad en la prestación del servicio de agua potable en las zonas abastecidas por los tanques Cacique y Borbón, “lo cual fue motivado por un fallo súbito y no programado en el equipo de bombeo del denominado Dirección12, aprovechamiento que supone el 24% de la producción de agua potable para consumo humano del Sistema CO-A-01 El Pasito de Alajuela”. Por lo anterior, el ICAA remitió a las zonas afectadas camiones cisternas propios y alquilados a fin de garantizar la dotación mínima de subsistencia.
En consecuencia, en la especie no se comprueba que la problemática relacionada con la continuidad del suministro de agua potable en San José de Alajuela obedezca a una actuación arbitraria del ICAA, sino, a que en tal zona existen condiciones particulares en relación con la elevación topográfica y con el consumo de la población. Además, la discontinuidad sufrida en la prestación de tal servicio entre el 4 y el 8 de junio de 2022 se debió a una falla en el equipo de bombeo y, mientras se solucionaba, el ICAA envió camiones cisternas a las zonas afectadas para garantizar la dotación mínima de subsistencia.
Ergo, no procede acoger el recurso en los términos en que fue planteado. Adicionalmente, advierta la parte recurrente que no le corresponde a este Tribunal Constitucional valorar, de acuerdo con la normativa infraconstitucional que rige la materia y las particularidades del caso bajo estudio, la procedencia o no de las medidas adoptadas por el ICAA para solventar la problemática acusada en el sub lite, ni determinar las acciones específicas que debe efectuar ese instituto a los efectos de resolver lo concerniente a la discontinuidad del suministro de agua potable en San José de Alajuela.
Por ende, se declara sin lugar el amparo. No obstante, tomen nota las autoridades accionadas que deberán coordinar lo necesario y llevar a cabo todas las actuaciones que estén dentro del ámbito de sus competencias, a fin de garantizar el abastecimiento de agua potable a las personas usuarias de San José de Alajuela mediante camiones cisternas, hasta tanto no se culminen definitivamente las obras que pretenden dar una solución definitiva a la problemática acusada en el sub examine .
IV.Finalmente, advierta la parte accionante que no corresponde a esta sede especializada pronunciarse, de acuerdo con la normativa infraconstitucional que rige la materia y las particularidades del caso bajo estudio, sobre las disconformidades expuestas por la recurrente en relación con el contrato suscrito entre el ICAA y la empresa dueña de los camiones cisternas empleados en la zona donde reside. Por ende, si la tutelada lo tiene a bien, podrá plantear tales disconformidades ante la propia autoridad recurrida, o en la vía jurisdiccional ordinaria”.
En sentido similar al expuesto en los precedentes transcritos, en el sub lite el recurrente manifiesta su disconformidad con las actuaciones del Instituto Costarricense de Acueductos y Alcantarillados en relación con el desabastecimiento de agua en San José de Alajuela. Puntualmente reclama: 1) que no han encontrado una solución efectiva a la problemática presentada, 2) que los camiones cisterna y los funcionarios que reparten el agua no cumplen con las normas de higiene; y, 3) que el instituto accionado pretende que los vecinos instalen una toma de agua para abastecer los tanques, a pesar de que no tienen los medios económicos para ello.
Sobre el primer aspecto, esta Sala acredita que, si bien las autoridades del ICAA no han garantizado una solución definitiva a la problemática de desabastecimiento de agua en San José de Alajuela, esto no obedece a decisiones arbitrarias por parte del instituto. Lo anterior, tal como lo constató esta Sala en los precedentes de cita, donde se verificó que en esa localidad existen problemas en la continuidad del suministro de agua potable, derivada de “la elevación topográfica del lugar Buenos Aires, Dirección10, donde habitan los tutelados, en relación con el tanque Borbón, que es la infraestructura del AyA que atiende a esa comunidad. De lo expuesto, es claro que el desabastecimiento acusado por la parte recurrente en este asunto se debe al tipo de superficie donde está ubicado el barrio, que está a un nivel alto y más elevado del tanque de abastecimiento y no se debe a inercia del Instituto Costarricense de Acueductos y Alcantarillados” (véase en igual sentido la sentencia nro. 2020003518 de las 9:30 horas del 21 de febrero de 2020).
Asimismo, se acredita que el ICAA ha adoptado una serie de medidas para dar soluciones a la situación descrita. Verbigracia, se encuentra en etapa de ejecución el proyecto “Mejoras al sistema de acueducto de Pasito de Alajuela” y, de forma provisional, se abastece el agua potable por medio de camiones cisternas.
Ahora bien, en cuanto al segundo punto, en relación con la higiene en el abastecimiento por medio de camiones cisternas, las autoridades recurridas niegan los hechos, y manifiestan que “el agua se transporta en los camiones cisternas es cien por ciento potable, según la norma de calidad que se le exige a las empresas cisternas que son contratados por el AyA”. Además, adjuntan los informes de calidad del agua emitidos por el Laboratorio Nacional de Aguas.
Sobre el particular, debe advertirse que escapa de las posibilidades de esta Sala por la vía sumaria del amparo determinar si las medidas de higiene que se siguen en las labores de abastecimiento de agua son las óptimas. Asimismo, esta Sala no debe fungir como una instancia tramitadora de quejas, de modo que el reclamo en relación con la indumentaria de los operarios, el aseo del camión, la forma en la que se maneja la manguera y el alegado fumado por parte de los funcionarios, deberá ser planteado -si a bien lo tiene- ante la propia autoridad accionada, o en la vía jurisdiccional ordinaria.
Finalmente, en cuanto al reclamo relacionado con la obligación de construir una toma de agua para llenar los tanques de cada casa, del informe rendido bajo juramento se desprende que este comunicado fue dejado sin efecto previo a la interposición de este amparo, con ocasión de la reunión que se mantuvo el 31 de enero de 2023 entre representantes del Dirección10, el gerente general y funcionarios del área técnica de la Región Central Oeste del ICAA.
Ergo, en los términos en los que fue planteado el amparo, no se acreditan acciones u omisiones de relevancia constitucional por parte de las autoridades recurridas.
En consecuencia, procede desestimar el recurso de amparo, no sin antes advertir a las autoridades del ICAA que, deberán seguir llevando a cabo todas las actuaciones que estén dentro del ámbito de sus competencias, a fin de garantizar el abastecimiento de agua potable a las personas usuarias de San José de Alajuela mediante camiones cisternas, con el debido cumplimiento de las normas de higiene, hasta tanto no concluyan las obras que pretenden dar una solución definitiva a la problemática de desabastecimiento de agua en la zona afectada.”
IV.Sobre el caso concreto. En el presente asunto, después de analizar los elementos probatorios aportados y los informes rendidos bajo fe de juramento por las autoridades recurridas del Instituto Costarricense de Acueductos y Alcantarillados con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley de Jurisdicción Constitucional, se tiene por acreditado que la recurrente es vecina de Dirección01, en Dirección10. Tambien que a la fecha de interposición del recurso, sea, el 04 de abril de 2024, permaneció sin el servicio de agua durante cuatro días y si bien la autoridad recurrida informa que se efectúa el reparto de agua por medio de camiones cisterna, lo cierto es que afirma que ello se hace alternando las comunidades, de día de por medio y en cada visita se llenan los tanques de abastecimiento internos que tienen los habitantes de la zona.
Así las cosas, se acredita que la comunidad de la recurrente a pesar de que no contó con el servicio de agua de durante cuatro días, el suministro por camiones cisterna no se efectúa diariamente, lo implica que desabastecimiento de agua potable ha sido mayor a las ocho horas. De esta forma, se constata que el Instituto Costarricense de Acueductos y Alcantarillados ha lesionado los derechos fundamentales de la recurrente, toda vez que no ha tomado las medidas necesarias para garantizarle la continuidad del servicio de agua potable y ante la aplicación de racionamientos no ha dispuesto ni ha cumplido un horario claro y previamente determinado, ni ha dispuesto el suministro por medio de camiones cisterna en horarios también previamente definidos. En consecuencia, se declara con lugar el recurso con las consecuencias que se establecen en la parte dispositiva de esta sentencia.
V.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Juan Manuel Quesada Espinoza en su condición de presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, o a quien en su lugar ocupe el cargo, que giren las órdenes pertinentes y lleve a cabo todas las actuaciones que estén dentro del ámbito de sus competencias, para que: a) de forma inmediata a la notificación de esta sentencia, se disponga y se ejecute un horario claramente definido en caso que sea necesario continuar con los racionamientos de agua potable en la comunidad de Dirección01 en Barrio San José de Alajuela; y b) de forma inmediata, garantice a través de alguna alternativa provisional, el suministro diario suficiente de agua potable para suplir las necesidades básicas de la población, cuando la interrupción del servicio sea por periodos de más ocho horas. Se advierte a la recurrida, o a quien ocupe su cargo, que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo, y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia en la vía contencioso-administrativa. Notifíquese.
