Document Review Decision No. 2024015681 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine thirty a.m. on June 7, 2024.

Writ of amparo (recurso de amparo) processed under expediente No. 24-003134- 0007-CO, filed by [Nombre01 001], identity card number [Valor CED01], against the MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE) and the MUNICIPALIDAD DE NICOYA.

Findings of Fact (Resultando):

  1. 1By a written submission entered into this Court’s Online Management System on February 6, 2024, the petitioner filed a writ of amparo against the Ministerio de Ambiente y Energía and the Municipalidad de Nicoya. He states that works to eliminate wetlands and mangroves, as well as filling activities affecting areas of high environmental fragility and the State’s Natural Heritage (Patrimonio Natural del Estado), are being carried out in the wetland and estuary of the río Lagarto in Playa Sámara. Although the community is aware of these activities, the respondents have taken no measures to restore and protect these public resources. The actions carried out within the wetland contravene the regulations of the Secretaría Técnica Nacional Ambiental (SETENA), which classify Maritime-Terrestrial Zones (Zonas Marítimo Terrestres, ZMT) and wetlands as areas of high environmental fragility. This is based on the Reglamento de Evaluación, Control y Seguimiento Ambiental, pursuant to Decreto Ejecutivo No. 43898-MINAE-S-MOPT-MAG-MEIC, issued on December 21, 2022.Accordingly, on April 8, 2022, an environmental complaint (denuncia ambiental) was filed with MINAE’s SINAC, requesting information, corrective measures, and the demarcation and restoration of the affected areas (see evidence submitted). However, although 669 days have elapsed since the complaint was filed, it has not been resolved by the competent authorities. He argues that an on-site inspection is required to verify the claims and provide copies of the corresponding reports. He also requests that measures be taken to resolve the reported situation, including the placement of boundary markers (amojonamiento) in the mangrove areas, restoration of the affected land, and coordination with the Municipalidad de Nicoya to correct the erroneous zoning designation for the area comprising properties No. 502050001558Z, No. 502050091356 and No. 502050109521 in its Coastal Regulatory Plan (Plan Regulador Costero).He complains that, despite the claim, that local government has granted concessions in the ZMT, thereby failing to honor prior commitments. It is evident that both SINAC and the municipality have failed to fulfill their environmental obligations, particularly regarding wetland restoration and compliance with the Principle of Irreducibility (Principio de Irreductibilidad). The competent authorities’ failure to act has led to despair, as he does not believe that SINAC is willing to implement ecological restoration measures or respect the Principle of Irreducibility in an area of great environmental fragility within the ZMT. He considers that the facts presented violate his fundamental rights. He requests that the petition be granted, with the consequences prescribed by law.
  2. 2In a written submission dated February 20, 2024, Jaclin Rivera Wong, Coordinator of the Programa Nacional de Humedales of the Sistema Nacional de Áreas de Conservación (SINAC), reports as follows: FIRST: The petitioner alleges that works to eliminate wetlands and mangroves, as well as filling activities affecting areas of high environmental fragility and the State’s Natural Heritage, are being carried out in the wetland and estuary of the río Lagarto in Playa Sámara. Although the community is aware of these activities, the respondents have taken no measures to restore and protect these public resources. He further alleges that, on April 8, 2022, an environmental complaint was filed with MINAE’s SINAC requesting information, corrective measures, and the demarcation and restoration of the affected areas. However, although 669 days have elapsed since the complaint was filed, it has not been resolved by the competent authorities.In this regard, it must be clarified that the Programa Nacional de Humedales, created by Decreto ejecutivo N° 36427-MINAET DEL 25 DE ENERO DEL 2011 for the purpose of promoting, planning, and developing Costa Rica’s wetlands, performs strategic and coordination work at the national level and provides specific assistance in cases referred by state institutions to support their resolution, always in keeping with the purpose for which it was created. In view of this, complaints are handled by each Área de Conservación, and complaints concerning wetlands are no exception. In addition, the Programa Nacional de Humedales is neither notified of nor involved in handling such complaints unless an Área de Conservación expressly requests its assistance with a specific case. It must be clarified that the cases received by the Programa Nacional de Humedales in 2022 were reviewed, comprising a total of 37 inquiries, and none matches the information provided by the petitioner concerning the wetland and estuary of the río Lagarto in Playa Sámara.Therefore, there is no record of any inquiry or involvement by this program in handling this complaint following a request from the Área de Conservación. It is also stated that this program has no record of this case having been referred by the Municipalidad de Nicoya.
  3. 3By filing dated 22 de febrero de 2024, David Chavarría Morales, acting executive director of the Sistema Nacional de Áreas de Conservación (SINAC), reports as follows: FIRST: The appellant alleges that: “In the wetland (humedal) and estuary (estero) of the río Lagarto in Playa Sámara, works are being carried out to eliminate wetlands and mangroves, as well as filling operations that affect areas of high environmental fragility and the State Natural Heritage (Patrimonio Natural del Estado). Although the community is aware of these activities, the respondents have taken no measures to restore and protect these public resources. (…) Consequently, on 8 de abril de 2022, an environmental complaint was filed with SINAC of MINAE, requesting information, corrective actions, and the delimitation and restoration of the affected areas.” First, it must be clarified that the events described by the appellant do not fall within the territorial jurisdiction of the Área de Conservación Arenal Tempisque (ACAT), as was erroneously stated in the decision serving notice of the appeal; the canton of Nicoya falls within the jurisdiction of the Área de Conservación Tempisque (ACT), and therefore the technical input needed to prepare the report concerning this amparo proceeding (recurso de amparo) was requested from that Conservation Area.Accordingly, by means of an unnumbered document digitally signed on 22 de febrero del 2024, Nelson Marin Mora, Regional Director of the Área de Conservación Tempisque, addressed the events described by the appellant as follows. Mr. Nelson denies that ACT’s records contain a complaint filed on 8 de abril del año 2022 concerning the area corresponding to Playa Sámara and the río Lagarto estuary; the complaints that can be verified in the SITADA system were filed more recently and are recorded under the following service codes: 43590-2023 and 44055-2023, dated 26 de octubre del 2023 and 21 de noviembre del 2023, respectively. Accordingly, it is not true that SINAC has gone 669 days without addressing the complaints filed; however, ACT must promptly develop a schedule for conducting the corresponding field visits in response to the complaints filed at the end of 2023, so as to determine whether the events allegedly reported therein constitute an environmental offense (ilícito ambiental) under the regulations currently in force.SECOND: Through ACT, SINAC has performed a series of tasks aimed at identifying and protecting the wetlands located in the Playa Sámara–río Lagarto estuary area. These tasks are referenced in the document mentioned above and are described as follows: “On 04 de abril del año 2019, by official letter DIG-TOT-0111-2019, a cartographic and photographic-interpretation study entitled ‘Estudio Fotointerpretativo Retrospectivo del Manglar Ubicado al Oeste del río Lagarto en Playa Sámara,’ corresponding to official letter DIG-TOT-INF-018- 2019, was received from Mr. Jonnathan Jiménez Zúñiga, coordinator of the Territorial Classification subprocess of the Instituto Geográfico Nacional. The study was prepared by geographer Giovanni Oconotrillo Chaves, analyst for the Territorial Classification subprocess of the Registro Nacional, Departamento Topográfico y Observación del Territorio of the Instituto Geográfico Nacional, and is submitted with this response.On 04 de marzo del año 2021, by official letter ACT-OR-DR-0274-21, biologist Mauricio Mendez, an official of the Área de Conservación Tempisque, identified the tidal inlet (ría) on Río Lagarto in Playa Sámara. On 16 de junio del año 2021, through technical report ACT-OR–T–313-2021, surveyor Fabian Bonilla Salguero issued an opinion on the delimitation of the estuarine-system wetland (humedal tipo sistema estuarino) located in the area (estuary–tidal inlet) at the mouth of the río Lagarto, which concluded as follows: (…) The sequence of photographs shows the degradation suffered by the mangrove over the decades, with a clear reduction in its area visible in the photographs from 1945, 1989 and 1996, although the specific point in time when this occurred cannot be determined. Beginning in 1996, fill can be observed over the mangrove, which ultimately and completely altered its condition as a wetland and mangrove forest, because the fill prevents the entry of salt water from the tides and, consequently, natural regeneration (…).A review of the Registro Nacional de la Propiedad’s cadastral information system (SIRI) regarding the areas reported in the appeal shows that these lands are registered under property number 502050109521 and concessions (concesiones) 502050001558Z and 502050091356 by the Municipalidad de Nicoya. Accordingly, action must be taken before the Registry to deregister these properties and terminate the concessions so that the Área de Conservación Tempisque—which is indeed interested in achieving restoration—may proceed. However, the matter must first be legally resolved through the cancellation of those property numbers, after which we may physically delimit the wetland and prepare a restoration proposal that considers the site’s new conditions, as it has undergone very significant changes over the past 30 years. Once the legal and administrative process has been completed, the Conservation Area will begin budgeting the resources required for the technical restoration work at the site through a wetland remediation plan (plan reparador del humedal) intended to restore the ecosystem, whereupon the Conservation Area will begin implementing the restoration strategy.” THIRD: As may be seen from the information prepared by the Área de Conservación Tempisque, since 2019 work has been underway to identify, classify, and verify the presence of estuarine-system wetlands in the Playa Sámara–río Lagarto estuary sector.In addition to the work mentioned in the second section, SINAC issued a procedure intended to provide technical officials of SINAC’s Conservation Areas with the internal guidelines required to identify estuaries–tidal inlets–mangroves (all estuarine-system wetlands under the classification established by the Convención Ramsar and adopted by Costa Rica). Accordingly, in 2021 the procedure entitled “IDENTIFICACIÓN Y DELIMITACIÓN DE HUMEDALES TIPO SISTEMA ESTUARINO” was issued. Through that procedure, the ACs have made progress in identifying wetlands, particularly tidal inlets, because under Article 69 of the Ley de aguas N°276, their delimitation is required in order to determine, in turn, the maritime-terrestrial zone (zona marítimo terrestre) extending 200 meters across from the identified tidal-inlet point. Notwithstanding the foregoing, with respect to the specific Playa Sámara–Río Lagarto area, there is a problem dating back many years that poses new difficulties for SINAC in classifying wetlands, particularly in identifying mangroves.This is because SINAC’s principal source for determining whether land-use change (cambio de uso de suelo) actually occurred through the elimination of this type of ecosystem and the placement of fill in its stead is the photographic-interpretation study provided by IGN in 2019. That study shows what appears to have been tree cover consisting of mangrove trees before 1996 in sectors where buildings and fill are currently found. Along the same lines, SINAC must allocate financial and human resources to conduct soil studies using suitable tools and machinery, a task requiring planning and time to complete. Likewise, there is the problem of properties registered under Nombre01 of private parties and under Nombre01 of the Municipality on lands potentially subject to State Natural Heritage restrictions (wetlands within the ZMT). It is therefore also necessary to initiate proceedings to cancel those properties so they may subsequently be registered under Nombre01 of MINAE (Article 13 of the Ley Forestal N°7575).Given the foregoing, it is evident that the problem in the Playa Sámara–río Lagarto estuary sector arises from a situation dating back approximately 30 years and that SINAC has indeed made progress in identifying wetlands, as demonstrated by the identification of the Ría del Río Lagarto and the verification of lands where mangroves appear to have existed in the past and where forest cover (cobertura) began to be removed starting in 1996. Several proceedings before the administrative authorities remain unresolved, including expediente 2011-01409-RIM, which involves property 5-1558-Z (allegedly registered within a mangrove); judicial proceedings must also be undertaken to declare the registration of those properties null and void, followed by processes to restore and rehabilitate the ecosystems with the involvement of stakeholders both within and outside the institution.
  4. 4By written submission incorporated into the electronic case file on 23 de febrero de 2023, Nelson Marin Mora, Regional Director of the Área de Conservación Tempisque (ACT) of the Sistema Nacional de Áreas de Conservación (SINAC), reports as follows: FIRST: In this amparo proceeding (amparo), the petitioner states: “(…) in the wetland (humedal) and estuary (estero) of the Río Lagarto in Playa Sámara, works are being carried out to eliminate wetlands and mangroves (manglar), as well as filling operations (rellenos) affecting areas of high environmental fragility and the State Natural Heritage (Patrimonio Natural del Estado) (…) He asserts that a field inspection is required to verify the claims and provide copies of the corresponding reports. In addition, measures are requested to resolve the reported situation, including the demarcation with boundary markers (amojonamiento) of the mangrove areas, the restoration of the affected lands, and coordination with the Municipalidad de Nicoya to correct the erroneous zoning (an area comprising properties No. 502050001558Z, No. 502050091356 and No. 502050109521 in its Coastal Regulatory Plan (Plan Regulador Costero))(…) SECOND: The Environmental Complaints System (Sistema de Denuncias Ambientales) ((SITADA) contains no complaint concerning the aforementioned sector referred to by the complainant; the complaints concerning that site are recent, namely 43590-2023 and 44055-2023, dated 26 de octubre del 2023 and 21 de noviembre del 2023, respectively.THIRD: With respect to the actions taken by the State Forestry Administration (Administración Forestal del Estado), represented by the Área de Conservación Tempisque (ACT) of the Sistema Nacional de Áreas de Conservación (SINAC), it is reported that a series of actions have been undertaken to determine the area corresponding to a possible wetland at the site, as set forth below: On 04 de abril del año 2019, through official letter DIG-TOT-0111-2019, Mr. Jonnathan Jiménez Zúñiga, coordinator of the Territorial Classification subprocess of the Instituto Geográfico Nacional, submitted the cartographic and photointerpretive study (Estudio Cartográfico y fotointerpretativo) entitled “Estudio Fotointerpretativo Retrospectivo del Manglar Ubicado al Oeste del río Lagarto en Playa Sámara,” corresponding to official letter DIG-TOT-INF-018-2019, prepared by geographer Giovanni Oconotrillo Chaves, Analyst of the Territorial Classification subprocess of the Registro Nacional, Departamento Topográfico y Observación del Territorio of the Instituto Geográfico Nacional, which is provided with this response.On 04 de marzo del año 2021, through official letter ACT-OR-DR-0274-21, biologist Mauricio Mendez, an official of the Área de Conservación Tempisque, identified the tidal inlet (ría) on Río Lagarto in Playa Sámara. Beginning in 1996, fill can be seen over the mangrove, which ultimately and completely altered its condition as a wetland and mangrove forest (bosque de mangle), because the fill prevents the entry of salt water from the tides and, consequently, natural regeneration (…).FOURTH: Upon reviewing the cadastral information system (sistema de información catastral) of the Registro Nacional de la Propiedad (SIRI) regarding the areas identified in the appeal, it is important to note that these lands are registered as property number 502050109521 and concessions (concesiones) 502050001558Z and 502050091356 granted by the Municipalidad de Nicoya. Accordingly, action must be taken before the Registry to deregister those properties and terminate the concessions so that the Área de Conservación Tempisque—which does have an interest in achieving restoration—may proceed. However, the matter must first be legally resolved by canceling those property numbers so that we may physically delimit the wetland and prepare a restoration proposal that takes into account the site’s new conditions, as it has undergone very significant changes over the last 30 years. FIFTH: Once the legal and administrative process mentioned in section FOURTH has been completed, the Área de Conservación will begin budgeting the resources required for the technical restoration work at the site through a wetland remediation plan (plan reparador del humedal) to restore the ecosystem, whereupon the Área de Conservación will commence the restoration strategy.

Alexander León Campos, Director of the Área de Conservación Arenal Tempisque, states that Playa Samara lies outside the administrative jurisdiction of the Área de Conservación Arenal Tempisque and falls under the Área de Conservación Tempisque; for that reason, he is unable to provide the requested report.
  6. 6By written submission dated 27 de febrero de 2024, Carlos Armando Martínez Arias, Alcalde de Nicoya, reports that the complaint locates the alleged “works to eliminate wetlands and mangroves, as well as filling operations affecting areas of high environmental fragility and the State Natural Heritage,” asserting that those events occurred within what the petitioner calls property identifiers number: 502050001558Z, 502050091357, 502050109521. It must be emphasized that only the first corresponds to a property located in the maritime-terrestrial zone (zona marítimo terrestre), while the other 2 properties are privately owned lands registered with the Registro Nacional and fall outside this municipality’s jurisdiction. Those private properties are registered with the Registro Nacional as follows: real-property folio (folio real) 91356, cadastral plan (plano catastrado) number G-193418-2016, whose registered owner is Bancol S.A.; and real-property folio 109521, cadastral plan number G-1933416-2016, whose registered owner is Corporación Hotelera Sámara S.A., respectively, according to a search conducted in the Digital Queries database of the Registro Nacional de la Propiedad.Based on the foregoing, the reported facts fall within the jurisdiction of IGN, ACAT, SINAC and MINAE, given their status as entities whose organizational structure and functional coordination constitute, by legal mandate, the Administration of the State’s wetland and mangrove zones. Once the protection and/or conservation areas have been delimited by the authorities competent to do so, this municipality is responsible for granting or denying concessions. Accordingly, this representation will limit its response to matters concerning the property identified by the petitioner under property identifier number: 502050001558Z, corresponding to the property registered with the Registro Nacional, Bienes Inmuebles, Provincia de Guanacaste, under real-property folio number 1558-Z-000 and cadastral plan G-0797618-1989, which is concession land in the maritime-terrestrial zone. REGARDING THE REAL PROPERTY UNDER REAL-PROPERTY FOLIO Having reviewed the objections raised by the petitioner [mbre01 0 001] in case file No.24-003134-0007-CO, and within the scope of my authority, I hereby provide a report concerning the status of the property registered under concession in the Provincia de Guanacaste, under the registration number, in relation to the facts stated therein.First: The aforementioned concession was registered with the Registro Nacional on 03 de noviembre de 1989, under cadastral plan the , to re01 of of the company named “Corporación Hotelera Samara Sociedad Anónima”; its term expired on 03 de noviembre de 2009, and it is therefore currently undergoing review for an extension of the concession (prorroga concesionaria) and is registered under property identifier , pursuant to the declaration of a cadastral zone (zona catastrada) established by Decreto Ejecutivo No. 41678. A literal property certification (Certificación literal de propiedad) and cadastral plan are attached. The property is spatially located as follows, as shown in the Cadastral Information System (SIRI), https://siri.rnp.go.cr/SIRI/index.jsp: (…) Second: According to information from the Registro Nacional de Humedales, available through the Registro Nacional’s map viewer at http://www.snitcr.go.cr/Visor/index, no wetland is identified or depicted on the property registered under concession in the Provincia de Guanacaste, under registration number .Third: According to certification ACT-OR-DR-144-14, issued by the Sistema Nacional de áreas de Conservación, Área de Conservación Tempisque, regarding areas classified as State Natural Heritage, no estuary is identified or depicted within the entire area where the property registered under concession in the Provincia de Guanacaste, under registration number , is located. The certification and map are attached. Fourth: On 10 de febrero de 2022, this Municipality, through its Departamento de Gestión Ambiental and under official letter MN-DPTSA-DGA-96- 2023, addressed the environmental complaint filed by [1 001], 001], concerning property , in which that department stated as follows: “1. In the 1982-1983 official cartography of the Instituto Geográfico Nacional (Hoja Garza, scale 1:50.000), no wetland is depicted in the sector analyzed, even though the scale would have permitted it. Although detailed technical studies may eventually be conducted, Hoja Garza constitutes official data that must be considered in any complaint concerning harm to vulnerable ecosystems. 2.This environmental complaint was addressed two decades ago, and both administrative and judicial remedies were exhausted. The result was Judgment N°29- 04 in Case File 95-200090-390 in abril del 2004, and in septiembre del mismo año the appeal on points of law (recurso de casación) filed by the Procuraduría General de la República was denied. In those judicial proceedings, the details listed in your complaint, filed on 8 de abril del 2022, were subjected to legal analysis and an assessment of the evidence. In view of the foregoing, and pursuant to the Convención Americana de Derechos Humanos or Pacto de San José de Costa Rica, signed on 22 de noviembre de 1969 and approved through Ley 16 de 1972, Art. 8-4, under which ‘an accused person acquitted by a final judgment may not be subjected to a new trial for the same acts’; and, at the national level, the Constitución Política provides in Article 42 that ‘No one may be tried more than once for the same punishable act,’ it is not appropriate to reopen administrative due process proceedings carrying criminal consequences for exactly the same act at the same site.” The document transcribed above, a copy of which is provided, demonstrates that this municipal corporation has respected the rights of Mr. [01] al a 001] by addressing the document filed with the Municipalidad concerning the subject matter of these proceedings.Accordingly, this Municipality, through its Departamento de Zona Marítimo Terrestre and pursuant to the Principle of Publicity of Registry Records (Principio de Publicidad Registral), will maintain the registration and review of the property registered under concession in the Provincia de Guanacaste, under registration number , until the authority with jurisdiction over the matter determines the existence of any wetland or estuary that would allow us to exclude the sector from the concession-eligible area (área concesionable) and initiate any procedures required pursuant to the orders of the competent authority.
  7. 7By memorial dated 05 de marzo de 2024, the petitioner responds to the reports submitted and requests that the appeal be granted.
  8. 8By written submission dated 06 de marzo de 2024, Mr. Nombre02 requests recognition as an assisting party (parte coadyuvante) in this appeal and that the appeal be granted in all respects.
  9. 9The statutory requirements have been observed in the proceedings conducted.

Whereas:

I. PRELIMINARY MATTER

Before analyzing the merits of the matter—regarding the alleged violation of the right to prompt and proper proceedings—it must be clarified that, since Judgment No. 2008-02545 of 8:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings (procedimientos administrativos especiales), for issuing a final administrative act concluding an administrative proceeding—initiated ex officio or at the request of a party—or for hearing the applicable administrative appeals (recursos administrativos). This case specifically presents an exception, because it concerns a complaint filed with the Área de Conservación Tempisque regarding an environmental situation. Having clarified this point, the Chamber proceeds to resolve the specific situation raised in this constitutional protection action (amparo).

II. REGARDING THE REQUEST TO INTERVENE AS A SUPPORTING PARTY

Intervention as a supporting party (coadyuvancia) is a form of procedural intervention in which a person participates in a proceeding by joining the claims of one of the principal parties. Accordingly, anyone with a direct interest in the outcome of the action has standing to participate as a supporting party (coadyuvante); however, because the supporting party is not a principal claimant, that party is not directly affected by the judgment—that is, its effect cannot apply to that party directly and immediately, nor is that party affected by the judgment’s res judicata effect (cosa juzgada), although in constitutional protection matters the supporting party may benefit from the effect of the decision because of the erga omnes nature of the case law and precedents of the constitutional jurisdiction (Article 13 of the Ley de la Jurisdicción Constitucional). Based on the foregoing and pursuant to Article 34 of the Ley de la Jurisdicción Constitucional, the application is accepted and the requested intervention as a supporting party before this Chamber is granted.

III. SUBJECT MATTER OF THE ACTION

- The petitioner states that, in the wetland (humedal) and estuary (estero) of the río Lagarto in Playa Sámara, work is being carried out to eliminate wetlands and mangrove forest (manglar), together with filling operations (rellenos) affecting areas of high environmental fragility and the State Natural Heritage (Patrimonio Natural del Estado) (an area comprising properties No. 502050001558Z, No. 502050091356 and No. 502050109521 under its Coastal Regulatory Plan (Plan Regulador Costero)). He states that, on 8 de abril de 2022, an environmental complaint was filed with SINAC, requesting information and corrective measures, as well as the delimitation and restoration of the affected areas. However, he alleges that the competent authorities have not resolved it. He also complains that, notwithstanding that complaint, the local government has granted concessions in the Maritime-Terrestrial Zone (Zona Marítimo Terrestre, ZMT).

IV. PROVEN FACTS

The following facts are deemed duly established and relevant to the decision in this matter:

  • a)On 04 de abril de 2019, the Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional, through official letter DIG-TOT-0111-2019, forwarded to the Área de Conservación Tempisque the cartographic and photo-interpretive study entitled “Retrospective Photo-Interpretive Study of the Mangrove Forest Located West of the río Lagarto in Playa Sámara” (“Estudio Fotointerpretativo Retrospectivo del Manglar Ubicado al Oeste del río Lagarto en Playa Sámara”). (See report submitted by SINAC and evidence provided.)
  • b)On 04 de marzo del año 2021, through official letter ACT-OR-DR-0274-21, biologist Mauricio Méndez, an official of the Área de Conservación Tempisque, identified the ria (ría) on Río Lagarto in Playa Sámara. (See report submitted by SINAC and evidence provided.)
  • c)On 16 de junio del año 2021, technical report ACT-OR–T–313-2021, issued by surveyor Fabian Bonilla Salguero, provided an opinion regarding the delimitation of the estuarine-system wetland present in the area (estuary-ria) at the mouth of the río Lagarto, concluding as follows: “Conclusion: The sequence of photographs shows the degradation suffered by the mangrove forest over the decades, with a clear reduction in its area visible in the photographs from 1945, 1989 and 1996, although the historical point at which this occurred cannot be precisely determined. Beginning in 1996, fill can be seen over the mangrove forest, which ultimately completely altered its status as a wetland and mangrove forest, because the fill prevents saltwater from the tides from entering and, consequently, prevents natural regeneration. The fill placed over the area identified by IGN as mangrove forest is presumed to consist of several hundred or perhaps thousands of cubic meters of already compacted material, because, if Figure 18 is analyzed, the extent of the mangrove forest would be approximately 96482.37 m², with an approximate fill thickness of 0.5 m, which would yield a material volume of 48241.18 m³.

Accordingly, this large quantity of material is beyond the capacity of the Área de Conservación to remove for purposes of conducting soil investigations that would produce a soil study, an input frequently used to determine the extent of wetlands. This is due to the undetermined—but unquestionably very substantial—financial investment that would be required for machinery, personnel, and other expenses associated with removing that fill. In this regard, the technically sound and clear information available concerning the original extent of the mangrove forest on the western bank of Estero Lagarto is report DIGTOT-0111-2019, prepared by IGN, the entity with jurisdiction over this subject matter.” (See report submitted by SINAC and evidence provided.)

  • d)On 08 de abril de 2022, the protected party filed—in hard copy—with the Área de Conservación Tempisque of the Ministerio de Ambiente y Energía an environmental complaint concerning the destruction of mangrove forest and wetlands, together with a request for a report. (See documentation submitted with the initial filing.)
  • e)According to SINAC, the specific Playa Sámara-Río Lagarto area has faced a long-standing problem involving difficulties in identifying and classifying wetlands. This is because the principal information available to SINAC for determining whether a land-use change (cambio de uso de suelo) actually occurred through the elimination of this type of ecosystem and the placement of fill in its place consists of the photo-interpretation study provided by IGN in 2019. Consequently, financial and human resources must be allocated to conduct soil studies using suitable tools and machinery, a task requiring planning and time to complete. (See report submitted by SINAC and evidence provided.)
  • f)According to SINAC, there is a verified problem involving properties registered under Nombre01 of private parties and under Nombre01 of the Municipalidad on land potentially affected by State Natural Heritage status (wetlands in the ZMT). It is therefore also necessary to initiate proceedings to annul the registration of those properties so that they may subsequently be registered under Nombre01 of MINAE (Article 13 of Ley Forestal N°7575). (See report submitted by SINAC and evidence provided.)
  • g)According to SINAC, the resolution of certain administrative proceedings remains pending, including expediente 2011-01409-RIM, which involves property 5-1558-Z (allegedly registered within mangrove forest), as do the judicial proceedings seeking declarations that the registrations of those properties are null and void and the subsequent proceedings for the restoration and rehabilitation of the ecosystems, with the involvement of parties both within and outside the institution. (See report submitted by SINAC and evidence provided.)
  • h)Properties 502050091357 and 502050109521 are privately owned lands registered in the Registro Nacional, respectively, under: real-property folio 91356, cadastral plan number G-193418-2016, whose registered owner is Bancol S.Nombre03.; and real-property folio , cadastral plan number G-1933416-2016, whose registered owner is Corporación Hotelera Sámara S.A. (See report submitted by the Municipalidad de Nicoya and evidence provided.)
  • i)Property 502050001558Z corresponds to the property registered in the Registro Nacional, Bienes Inmuebles, Provincia de Guanacaste, under real-property folio number , cadastral plan G-0797618-1989, constituting land held under a maritime-terrestrial-zone concession. (See report submitted by the Municipalidad de Nicoya and evidence provided.)
  • j)On 03 de noviembre de 1989, the concession was registered with the Registro Nacional under cadastral plan G-0797618-1989, under Nombre01 of the company named “Corporación Hotelera Samara Sociedad Anónima”; its term expired on 03 de noviembre de 2009, and the extension of the concession is currently under review. (See report submitted by the Municipalidad de Nicoya and evidence provided.)
  • k)According to certification ACT-OR-DR-144-14, issued by the Sistema Nacional de áreas de Conservación, Área de Conservación Tempisque, concerning the areas classified as State Natural Heritage, no estuary is identified or depicted within the total area on which the concession property registered in the Provincia de Guanacaste under registration number is located. (See report submitted by the Municipalidad de Nicoya and evidence provided.)
  • l)On 10 de febrero de 2022, the Departamento de Gestión Ambiental of the respondent municipality, through official letter MN-DPTSA-DGA-96-2023, responded to the complaint filed by the protected party—associated with property 5- 1558-Z-000—as follows: “1. In the official 1982-1983 cartography of the Instituto Geográfico Nacional (Hoja Garza, scale 1:50.000), no wetland is depicted in the area analyzed, even though the scale permitted it. Although detailed technical studies may eventually be conducted, the Hoja Garza constitutes official information that must be considered in any complaint concerning harm to vulnerable ecosystems. 2. This environmental complaint was addressed two decades ago, culminating in the exhaustion of administrative and judicial remedies. As a result, Judgment N°29- 04 in Expediente [Valor 003] was issued in abril del 2004, and in septiembre del mismo año the appeal in cassation (recurso de casación) filed by the Procuraduría General de la República was denied.

In that judicial proceeding, the details listed in your complaint filed on 8 de abril del 2022 were subjected to legal analysis and evaluation of the evidence. In view of the foregoing, and pursuant to the Convención Americana de Derechos Humanos or Pacto de San José de Costa Rica, signed on 22 de noviembre de 1969 and approved through Ley 16 de 1972, Art. 8-4, under which ‘an accused person acquitted by a final judgment may not be subjected to a new trial for the same facts’; and, at the national level, the Constitución Política provides in Article 42 that ‘No one may be tried more than once for the same punishable act,’ it is not appropriate to reopen administrative due process (debido proceso administrativo) carrying criminal consequences for precisely the same act at the same location.” (See report submitted by the Municipalidad de Nicoya and evidence provided.)

V. UNPROVEN FACT

- The following relevant fact has not been established: Sole fact) That the respondent authority provided a response to the complaint filed by the petitioner on 08 de abril de 2022.

VI. REGARDING THE ACTIONS OF THE SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN

- The petitioner states that, in the wetland (humedal) and estuary (estero) of the río Lagarto in Playa Sámara, works are being carried out to eliminate wetlands and mangrove forest (manglar), as well as filling activities affecting areas of high environmental fragility and the State’s Natural Heritage (Patrimonio Natural del Estado) (an area comprising properties No. 502050001558Z, No. 502050091356 and No. 502050109521 in its Coastal Regulatory Plan (Plan Regulador Costero)). He states that, on 8 de abril de 2022, an environmental complaint (denuncia ambiental) was filed with SINAC, requesting information, corrective action, and the delimitation and restoration of the affected areas. However, he alleges that the competent authorities have not resolved it.

The reports submitted by the representatives of the respondent authority—which are deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the body of evidence establish that, on 04 de abril de 2019, the Departamento Topográfico y Observación del Territorio of the Instituto Geográfico Nacional, by official letter DIG-TOT-0111-2019, forwarded to Área de Conservación Tempisque the cartographic and photo-interpretive study entitled “Retrospective Photo-Interpretive Study of the Mangrove Forest Located West of río Lagarto in Playa Sámara.” It is likewise established that, on 04 de marzo del año 2021, by official letter ACT-OR-DR-0274-21, biologist Mauricio Méndez, an official of Área de Conservación Tempisque, identified the tidal inlet (ría) on Río Lagarto in Playa Sámara. Similarly, it is established that, on 16 de junio del año 2021, technical report ACT-OR–T–313-2021, issued by surveyor Fabian Bonilla Salguero, provided an assessment concerning the delimitation of the estuarine-system wetland present in the area (estuary-tidal inlet) at the mouth of río Lagarto, concluding as follows: “Conclusion: The sequence of photographs shows the degradation suffered by the mangrove forest over the decades, with a clear reduction in its area visible in the photographs from the years 1945, 1989 and 1996, although the historical point at which this occurred cannot be precisely determined.

From 1996 onward, fill (relleno) can be observed over the mangrove forest, which ultimately altered its status as a wetland and mangrove forest entirely, because the fill prevents salt water from the tides from entering and, consequently, prevents natural regeneration. The fill placed over the area identified by IGN as corresponding to mangrove forest is presumed to comprise several hundred or perhaps thousands of cubic meters of already-compacted material, since, if figure 18 is analyzed, the mangrove forest would cover approximately 96482.37 m², with an approximate fill thickness of 0.5 m, which would yield a volume of material of 48241.18 m³. Accordingly, this large quantity of material exceeds the capabilities of Área de Conservación, insofar as removing that material would be necessary to perform soil analyses enabling the preparation of a soil study, an input frequently used to determine the extent of wetlands.

This is due to the undetermined, but undoubtedly very substantial, financial investment that would be required for machinery, personnel, and other expenses associated with removing that fill. In this regard, the technically sound and clear evidence available concerning the original extent of the mangrove forest on the western bank of Estero Lagarto is report DIGTOT-0111-2019, prepared by IGN, the competent entity in this field.” It is also established that, on 08 de abril de 2022, the protected party submitted—in physical form—to Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación (SINAC) an environmental complaint regarding destruction of mangrove forest and wetlands, together with a request for a report. In this regard, according to SINAC, the specific area of playa Sámara-Río Lagarto has a problem dating back many years that presents difficulties for the identification and classification of wetlands; this is because the principal input available to SINAC for determining whether there was in fact a land-use change (cambio de uso de suelo) that eliminated this type of ecosystem and replaced it with fill is the photo-interpretation study provided by IGN in the year 2019.

Consequently, financial and human resources must be allocated to conduct soil studies using suitable tools and machinery, a task that requires planning and time to complete. They add that the problem involves properties registered in Nombre01 of private parties and in Nombre01 of the Municipalidad on land potentially subject to the State’s Natural Heritage regime (wetlands in ZMT), and that it is also necessary to initiate proceedings to annul those property registrations so that they may subsequently be registered in Nombre01 of MINAE (Article 13 of the Ley Forestal N°7575). They further state that certain proceedings remain pending at the administrative level, as in the case of expediente 2011-01409-RIM, which involves property 5-1558-Z (allegedly registered within mangrove forest), as do the judicial proceedings to declare those property registrations null and void and the subsequent ecosystem restoration and rehabilitation processes, involving actors both within and outside the institution.

Notwithstanding the foregoing, there is no evidence of any action by the respondent authority after technical report ACT-OR–T–313-2021, issued on 16 de junio de 2021, or that the petitioner was provided with a response to the complaint filed on 08 de abril de 2022.

Accordingly, the violation of the protected party’s fundamental rights is established. This is because it has been determined that the complaint filed by the petitioner on 08 de abril de 2022 has not been resolved by the respondent authority. There is not even any record of steps taken to process it or that the protected party was informed of any such steps; instead, the authority merely recounts actions taken in the years 2019 and 2021—before the complaint—when a technical report was issued regarding the situation in the area at issue in this proceeding. In addition, it should be noted that the authorities of the Sistema Nacional de Áreas de Conservación (SINAC) acknowledge the existence of a problem dating back many years that presents difficulties for the identification and classification of wetlands; this is because the principal input available to SINAC for determining whether there was in fact a land-use change that eliminated this type of ecosystem and replaced it with fill is the photo-interpretation study provided by IGN in the year 2019.

In that regard, they merely state that financial and human resources must be allocated to conduct soil studies using suitable tools and machinery, a task requiring planning and time to complete, but they identify no specific short-, medium-, or long-term actions to determine the actual circumstances of the reported problem and provide a definitive solution. For the foregoing reasons, the application is granted under the terms set forth in the operative portion.

VII. REGARDING THE ACTIONS OF THE RESPONDENT MUNICIPALIDAD

The petitioner complains that, despite that complaint, the local government has granted concessions (concesiones) in the Maritime-Terrestrial Zone (Zona Marítimo Terrestre, ZMT). The reports submitted by the representatives of the respondent authority—which are deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the body of evidence establish that properties 502050091357 and 502050109521 are privately owned land registered in the Registro Nacional under, respectively: real-property folio (folio real) 91356, cadastral plan (plano catastrado) number G-193418-2016, whose registered owner is Bancol S.A.; and real-property folio 109521, cadastral plan number G-1933416-2016, whose registered owner is Corporación Hotelera Sámara S.A. Property 502050001558Z, for its part, corresponds to the property registered in the Registro Nacional, Bienes Inmuebles, Provincia de Guanacaste, under real-property folio number 1558-Z-000, cadastral plan G-0797618-1989, as land held under a Maritime-Terrestrial Zone concession.

Regarding that land, it is established that, on 03 de noviembre de 1989, the concession was registered with the Registro Nacional under cadastral plan G-0797618-1989 in Nombre01 of the company called “Corporación Hotelera Samara Sociedad Anónima”; its term expired on 03 de noviembre de 2009, and an extension of the concession is currently under review. Finally, it is established that, on 10 de febrero de 2022, the Departamento de Gestión Ambiental of the respondent municipality, by official letter MN-DPTSA-DGA-96-2023, responded to the complaint filed by the protected party—associated with property 5- 1558-Z-000—as follows: “1. At the level of the official 1982-1983 cartography of the Instituto Geográfico Nacional (Hoja Garza, scale 1:50.000), no wetland is depicted in the area analyzed, even though the scale would have permitted it. Although detailed technical studies may eventually be performed, Hoja Garza constitutes official data that must be considered in any complaint concerning harm to vulnerable ecosystems. 2.

This environmental complaint was addressed two decades ago, and both administrative and judicial remedies were exhausted. As a result, in abril del 2004, Judgment N°29- 04 was issued in Expediente [Valor 003], and in septiembre del mismo año the appeal on points of law (recurso de casación) requested by the Procuraduría General de la República was dismissed. In those judicial proceedings, the details listed in your complaint, filed on 8 de abril del 2022, were subjected to legal analysis and evidentiary assessment. In view of the foregoing, and pursuant to the Convención Americana de Derechos Humanos or Pacto de San José de Costa Rica, signed on 22 de noviembre de 1969 and approved by Ley 16 de 1972, Art. 8-4, under which ‘an accused person acquitted by a final judgment may not be subjected to a new trial for the same facts’; and, at the national level, the Constitución Política provides in Article 42 that ‘No one may be tried more than once for the same punishable act,’ it is not appropriate to reopen an administrative proceeding observing due process and carrying criminal consequences for exactly the same act at the same location.” Accordingly, no violation of the protected party’s fundamental rights is established.

It has been determined that, of the three properties identified by the protected party in the filing that initiated these proceedings, only property 502050001558Z corresponds to land held under a Maritime-Terrestrial Zone concession, having been registered as such since the year 1989. It is likewise established that the term of the concession expired in the year 2009 and that an extension of the concession is currently under review. In other words, the petitioner’s claim concerns a future and uncertain event, since the respondent municipality has not yet determined whether the concession over the land should be extended. Moreover, it should be noted that, since 10 de febrero de 2022, the Departamento de Gestión Ambiental of the respondent municipality has informed the protected party that the complaint concerning harm to vulnerable ecosystems on property 5- 1558-Z-000 had already been adjudicated in judicial proceedings under expediente No. [Valor 003]. Accordingly, there is no evidence of any action or omission by the municipal entity warranting the Court’s intervention. Therefore, this portion of the application must be dismissed, as it hereby is.

IX. NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE

I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the legal dispute must be heard by the Administrative Litigation Courts (Tribunales de lo Contencioso-Administrativo) and not by this Chamber. However, with the recent enactment of Law No. 9097, the Law Regulating the Right of Petition (Ley de Regulación del Derecho de Petición), it has been established that this right is eligible for judicial protection through the amparo proceeding (recurso de amparo) established in Article 32 of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional), in conjunction with Article 27 of the Political Constitution of the Republic of Costa Rica, in those cases in which the petitioner considers that the Administration’s material actions, administrative acts (actos administrativos), or response are affecting the petitioner’s fundamental rights.

In my view, the recently enacted legislation does not mean that this Court must modify its line of precedent, as, pursuant to Section 7 of its Law, it has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances that may indeed be heard in this jurisdiction through the constitutional guarantee proceeding of amparo, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 at 8:55 hours on 22 de febrero de 2008), jurisdiction lies with the judges of the administrative litigation jurisdiction (jurisdicción de lo contencioso-administrativo), all of which is consistent with Section 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal system.

X. DISSENTING OPINION OF JUSTICE SALAZAR ALVARADO

With due respect, I dissent from the majority opinion partially granting the petition, for the following reasons:

The protection of a healthy and ecologically balanced environment, under the Costa Rican legal system, is safeguarded not only by Article 50 of the Political Constitution, but also by a series of laws and executive decrees (regulations) currently in force, such as the Organic Law of the Environment (Ley Orgánica del Ambiente), Law N° 7554 of 4 de octubre de 1995; the Biodiversity Law (Ley de Biodiversidad), Law N° 7788 of 30 de abril de 1998; the Wildlife Conservation Law (Ley de Conservación de la Vida Silvestre), Law N° 7317 of 21 de octubre de 1992; and Executive Decree N° 31849 of 24 de mayo de 2004, General Regulations on Environmental Impact Assessment Procedures (Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental, EIA), to cite only a few. In environmental matters, this makes it necessary to distinguish constitutional review (control de constitucionalidad) from legality review (control de legalidad).

In this regard, it is the undersigned’s view that this Chamber, through amparo, should hear a matter alleging a violation of the right to a healthy and ecologically balanced environment only if the Administration has not yet intervened and if the violation of that right is manifest and evident, readily ascertainable, of some importance or seriousness, and directly affects a specific person or community. Otherwise, the issue must be raised and litigated through legality proceedings (vía de legalidad). Therefore, mere noncompliance with obligations and duties legally imposed on the various public administrations in environmental matters is properly heard through legality proceedings—whether administrative or judicial—where the alleged failures or omissions may be reviewed much more comprehensively. It must be borne in mind that an amparo proceeding is summary, informal, simple, and expeditious; consequently, from the very moment the Administration intervenes in an environmental matter in the exercise of its powers and conducts a proceeding culminating in the issuance of administrative acts, review of that matter falls outside the scope of this specialized jurisdiction.

Accordingly, review of administrative actions taken in connection with an environmental issue that, for proper assessment, requires a plenary proceeding (proceso de conocimiento pleno) is possible only in the ordinary courts, because the design of the amparo proceeding is incompatible with comparing or reviewing technical or legal criteria developed under the applicable statutory or regulatory provisions, or with the admission of additional and more extensive evidence necessary to compare or review the criteria already contained in the administrative record (expediente administrativo) for the case. The contrary would entail transforming amparo into an ordinary plenary proceeding, thereby distorting it and frustrating the purposes for which it was designed, causing it to lose its status as an instrument for the effective protection of fundamental rights. As a consequence of the foregoing, I consider that when a public entity or body has intervened in various ways, or has issued administrative acts concerning an environmental matter, review and oversight thereof fall within the administrative litigation jurisdiction.

It is precisely verification of the existence of such administrative intervention that determines that the matter falls within the jurisdiction of legality proceedings. Consequently, this petition should have been summarily dismissed (rechazado de plano), since its subject matter is an issue properly debated, analyzed, and decided through legality proceedings. However, because that was not done, the appropriate course is to deny it, without making any determination on the merits of the issue raised, since it falls to the ordinary jurisdiction—specifically, the administrative litigation jurisdiction—to determine whether the challenged administrative actions and conduct substantively conform to the provisions of the legal system having statutory rank concerning the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment.

XI. PARTIAL DISSENTING OPINION OF JUSTICE GARRO VARGAS REGARDING THE OPERATIVE PART OF THIS JUDGMENT

Although I agree with the majority of the Chamber that the petition should be granted, I disagree as to the forum in which the enforcement phase (fase de ejecución) of the matter should be conducted, due to the absence of adequate mechanisms under the rules governing this constitutional jurisdiction for monitoring compliance with a judgment involving highly complex technical matters—specifically, the order issued in paragraph b) of this judgment requiring that, within twelve months, studies be conducted to determine the actual circumstances of the reported problem that is the subject of this petition and to provide a definitive solution. By contrast, the provisions on enforcement contained in the Administrative Litigation Procedural Code (Código Procesal Contencioso-Administrativo) (Article 155 et seq.) offer clear advantages, such as the ability to require timetables, impose fines, assign responsibility, monitor stages of compliance, and so forth. Therefore, pursuant to Article 56 of the Constitutional Jurisdiction Law, I consider that the enforcement phase should be conducted before the Enforcement Division of the Administrative Litigation and Civil Treasury Court (Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda), under the judgment-enforcement rules of that Code.

XI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The petitioner is hereby advised that, if any paper document was submitted, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must be retrieved from the court within a maximum period of 30 business days from notice of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary” (“Reglamento sobre Expediente Electrónico ante el Poder Judicial”), approved by the Full Court at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

POR TANTO:

The petition is granted solely against the Sistema Nacional de Áreas de Conservación. David Chavarría Morales, acting executive director, and Nelson Marín Mora, regional director of the Área de Conservación Tempisque (ACT), both of the Sistema Nacional de Áreas de Conservación (SINAC), are ordered, within the scope of their authority, to: a) adopt and direct the necessary measures so that, within ONE MONTH from notice of this judgment, an appropriate response is provided to the complaint filed by the petitioner on 08 de abril de 2022, and the decision is communicated to him; b) likewise, undertake the relevant actions and coordination so that, within TWELVE MONTHS from notice of this judgment, the necessary and appropriate studies are conducted to determine the actual circumstances of the reported problem and provide a definitive solution. The foregoing is ordered with the warning that, pursuant to Article 71 of the Constitutional Jurisdiction Law, imprisonment for three months to two years, or a fine of twenty to sixty day-fines, shall be imposed on anyone who receives an order issued in an amparo proceeding that the person is required to comply with or enforce and who fails to comply with or enforce it, provided that the offense is not subject to a more severe penalty.

The State is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation jurisdiction. As to the Municipalidad de Nicoya, the petition is denied. Justice Castillo Víquez submits a note. Justice Salazar Alvarado dissents and would deny the petition, because it falls to the ordinary jurisdiction—specifically, the administrative litigation jurisdiction—to determine whether the challenged administrative actions and conduct substantively conform to the provisions of the legal system having statutory rank concerning the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment. Justice Garro Vargas dissents regarding enforcement of this judgment insofar as it concerns the order issued in paragraph b) and, pursuant to Article 56 of the Constitutional Jurisdiction Law, directs that it be carried out before the Enforcement Division of the Administrative Litigation and Civil Treasury Court, under the enforcement rules established in Articles 155 et seq. of the Administrative Litigation Procedural Code. She further orders that a copy of the judgment be forwarded to that court so that proceedings to enforce this ruling may begin. Notice shall be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del siete de junio de dos mil veinticuatro .

Recurso de amparo que se tramita en expediente No. 24-003134- 0007-CO, interpuesto por [Nombre01 001], cédula de identidad [Valor CED01], contra el MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE) y la MUNICIPALIDAD DE NICOYA.

Resultando:

  1. 1Por escrito incorporado al Sistema de Gestión en Línea de este Despacho el 06 de febrero de 2024, el recurrente interpone recurso de amparo contra el Ministerio de Ambiente y Energía y la Municipalidad de Nicoya. Manifiesta que, en el humedal y estero del río Lagarto de Playa Sámara, se están llevando a cabo obras de eliminación de humedales y manglar, así como rellenos que afectan áreas de alta fragilidad ambiental y Patrimonio Natural del Estado. Pese a que la comunidad es consciente de estas actividades, los recurridos no han tomado medidas para recuperar y proteger estos recursos públicos. Las acciones realizadas dentro del humedal son contrarias a la normativa de la Secretaría Técnica Nacional Ambiental (SETENA), que clasifica las Zonas Marítimo Terrestres (ZMT) y los humedales como áreas de alta fragilidad ambiental. Esto se sustenta en el Reglamento de Evaluación, Control y Seguimiento Ambiental, de acuerdo con el Decreto Ejecutivo No. 43898-MINAE-S-MOPT-MAG-MEIC, emitido el 21 de diciembre de 2022.Por lo anterior, el 8 de abril de 2022 se interpuso una denuncia ambiental ante el SINAC del MINAE, en la que se requirió información, acciones correctivas, así como la delimitación y restauración de las áreas afectadas (véase prueba aportada). Sin embargo, aunque han transcurrido 669 días desde el planteamiento la denuncia, esta no ha sido resuelta por las autoridades competentes. Aduce que se requiere una inspección en campo para verificar los reclamos y proporcionar copias de los informes correspondientes. Además, se solicita la toma de medidas para resolver la situación denunciada, en cuenta el amojonamiento de las áreas de manglar, la restauración de los terrenos afectados y la coordinación con la Municipalidad de Nicoya para corregir la zonificación errónea (área compuesta por las fincas No. 502050001558Z, No. 502050091356 y No. 502050109521 en su Plan Regulador Costero). Reclama que, pese al reclamo, dicho gobierno local ha otorgado concesiones en la Zona Marítimo Terrestre (ZMT), con lo cual incumple compromisos anteriores.Es evidente que tanto el SINAC como el municipio han fallado en cumplir con sus obligaciones ambientales, particularmente en lo que respecta a la restauración de los humedales y el cumplimiento del Principio de Irreductibilidad. La falta de acción por parte de las autoridades competentes ha llevado a la desesperanza, ya que no cree que el SINAC esté en disposición de implementar medidas de restauración ecológica ni a respetar el Principio de Irreductibilidad en un área de gran fragilidad ambiental dentro de la ZMT. Estima que los hechos expuestos violan sus derechos fundamentales. Solicita que se declare con lugar el recurso, con las consecuencias de ley.
  2. 2Mediante escrito de fecha 20 de febrero de 2024, Jaclin Rivera Wong, Coordinadora del programa Nacional de Humedales del Sistema Nacional de Áreas de Conservación (SINAC), informa que: PRIMERO: Alega el recurrente que, en el humedal y estero del río Lagarto de Playa Sámara, se están llevando a cabo obras de eliminación de humedales y manglar, así como rellenos que afectan áreas de alta fragilidad ambiental y Patrimonio Natural del Estado. Pese a que la comunidad es consciente de estas actividades, los recurridos no han tomado medidas para recuperar y proteger estos recursos públicos, además que el 8 de abril de 2022 se interpuso una denuncia ambiental ante el SINAC del MINAE, en la que se requirió información, acciones correctivas, así como la delimitación y restauración de las áreas afectadas. Sin embargo, aunque han transcurrido 669 días desde el planteamiento la denuncia, esta no ha sido resuelta por las autoridades competentes.Al respecto, se debe aclarar que el Programa Nacional de Humedales creado por el Decreto ejecutivo N° 36427-MINAET DEL 25 DE ENERO DEL 2011 con la finalidad de promover, planificar y desarrollar los Humedales de Costa Rica, implementa labores estratégicas y de coordinación a nivel nacional y da atención especifica de casos que son solicitados por instituciones estatales para el mejor resolver, siempre enfocado en la finalidad para lo cual fue creado. Considerando esto, la atención de denuncias es realizada por cada una de las Áreas de Conservación y para el caso de denuncias sobre humedales no es la excepción. Sumado a esto el programa Nacional de humedales no es notificado ni forma parte de la atención de estas denuncias, a excepción de la solicitud expresa del Área de Conservación para el acompañamiento de un caso específico. Debe aclararse que se ha realizado revisión de los casos recibidos por el programa nacional de humedales en el año 2022, para un total de 37 consultas y ninguno de ellos coincide con la información aportada por el recurrente (humedal y estero del río Lagarto de Playa Sámara), por lo tanto no se tiene registro de consulta o alguna participación de este programa en la atención de esta denuncia, previa solicitud del Área de Conservación. En este sentido, también se afirma que no se cuenta en este Programa con registro de este caso por parte de la Municipalidad de Nicoya.
  3. 3Por memorial de fecha 22 de febrero de 2024, David Chavarría Morales, director ejecutivo a.i del Sistema Nacional de Áreas de Conservación (SINAC), informa que: PRIMERO: El recurrente alega que: “en el humedal y estero del río Lagarto de Playa Sámara, se están llevando a cabo obras de eliminación de humedales y manglar, así como rellenos que afectan áreas de alta fragilidad ambiental y Patrimonio Natural del Estado. Pese a que la comunidad es consciente de estas actividades, los recurridos no han tomado medidas para recuperar y proteger estos recursos públicos. (…) Por lo anterior, el 8 de abril de 2022 se interpuso una denuncia ambiental ante el SINAC del MINAE, en la que se requirió información, acciones correctivas, así como la delimitación y restauración de las áreas afectadas”. En primer lugar, es necesario aclarar que los hechos indicados por el recurrente no son atribuibles a la competencia territorial del Área de Conservación Arenal Tempisque (ACAT) como por error se consignó en la resolución que brinda traslado del recurso, el cantón de Nicoya es competencia del Área de Conservación Tempisque (ACT) y por lo tanto los insumos técnicos para brindar informe al presente recurso de amparo fueron solicitados a dicha Área de Conservación.En este entendido, mediante documento sin número de oficio pero de fecha de firma digital 22 de febrero del 2024, el Director Regional del Área de Conservación Tempisque, Nelson Marin Mora procedió a referirse a los hechos indicados por el recurrente de la forma que se expresa de seguido. Niega don Nelson, que conste en los registros del ACT una denuncia efectuada el 8 de abril del año 2022 en la zona que corresponde a playa Sámara, estero del río Lagarto, las denuncias verificables en el sistema SITADA obedecen a fechas recientes y se computan con los siguientes códigos de atención: 43590-2023 y 44055-2023, con fecha del 26 de octubre del 2023 y del 21 de noviembre del 2023 respectivamente. Así las cosas, no es cierto que el SINAC lleva 669 días sin atender las denuncias interpuestas, pero el ACT debe proyectar a corto plazo un cronograma para efectuar las visitas de campo respectivas en atención de las denuncias presentadas a finales del año 2023 de forma tal que verifique si los hechos presuntamente denunciados en las mismas se configuran en algún ilícito ambiental de conformidad a la normativa vigente.SEGUNDO: El SINAC por medio del ACT ha efectuado una serie de labores orientadas a la identificación y protección de los humedales presentes en la zona de playa Sámara – estero del río lagarto, mismas referidas en el documento mencionado líneas arriba y que se describen de seguido: “En fecha 04 de abril del año 2019, mediante oficio DIG-TOT-0111-2019 se recibe de parte del señor Jonnathan Jiménez Zúñiga, coordinador del subproceso de Clasificación Territorial del Instituto Geográfico Nacional, Estudio Cartográfico y fotointerpretativo denominado “Estudio Fotointerpretativo Retrospectivo del Manglar Ubicado al Oeste del río Lagarto en Playa Sámara”, correspondiente al oficio DIG-TOT-INF-018- 2019, elaborado por el Geógrafo. Giovanni Oconotrillo Chaves, Analista subproceso de Clasificación Territorial del Registro Nacional, Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional, mismo que se aporta en este acto de respuesta.Que en fecha 04 de marzo del año 2021, mediante oficio ACT-OR-DR-0274-21, el Biólogo Mauricio Mendez, funcionario del Área de Conservación Tempisque, determina la ría sobre Río Lagarto en Playa Sámara. Que en fecha 16 de junio del año 2021, mediante informe técnico ACT-OR–T–313-2021, emitido por el Topógrafo Fabian Bonilla Salguero, se emite criterio sobre la delimitación del humedal tipo sistema estuarino presente en la zona (estero-ría) en la desembocadura del río Lagarto, el cual concluye lo siguiente (…) La secuencia de fotografías muestra la degradación que sufrió el manglar a lo largo de las décadas, con una clara reducción de su área que se observa en las fotografías de los años 1945, 1989 y 1996, sin que se pueda precisar el momento histórico en que esto ocurrió. A partir de 1996, se observa que sobre el manglar se encuentra un relleno que terminó de modificar completamente su condición de humedal y de bosque de mangle, pues el relleno impide el ingreso de agua salada proveniente de las mareas y con ello, la regeneración natural (…).En revisión del sistema de información catastral del registro nacional de la propiedad ( SIRI )de las áreas denunciadas en el recurso, es importante mencionar que estos terrenos se encuentran inscritos por el registro la finca número 502050109521 y concesiones 502050001558Z, 502050091356 por parte de la Municipalidad de Nicoya, por lo que se debe hacer acciones de des inscribir ante registro dichas propiedades y el cierre de las concesiones, para que el Área de Conservación Tempisque quien si tiene el interés de lograr una restauración, pero que sin embargo se debe de solventar jurídicamente con la anulación de esos números de finca para que procedamos a delimitar físicamente el humedal y realizar una propuesta de restauración considerando las nuevas condiciones del sitio, el cual ha tenido un cambio muy importante durante el paso de los últimos 30 años. Una vez realizado el proceso legal administrativo, el Área de Conservación procederá a dar inicio con la presupuestación de los recursos para las labores técnicas de restauración del sitio, mediante un plan reparador del humedal para restaurar el ecosistema, a lo cual, el Área de Conservación iniciara con en la estrategia de restauración.” TERCERO: Como se logra apreciar en el insumo efectuado por el Área de Conservación Tempisque, desde el año 2019 se han estado llevando a cabo labores en aras de identificar, clasificar y verificar la presencia de humedales tipo sistema estuarino en el sector de Playa Sámara- estero del río Lagarto.Además de las mencionadas en el apartado segundo, el SINAC procedió a emitir un procedimiento cuyo fin se orientaba en facilitar a los funcionarios técnicos de las Áreas de Conservación del SINAC los lineamientos internos necesarios para poder identificar: estuarios-esteros-rías-manglares (todos humedales de tipo sistema estuarino según la clasificación efectuada por la Convención Ramsar y adoptada por Costa Rica), así las cosas, en el año 2021 se emitió el procedimiento denominado: “IDENTIFICACIÓN Y DELIMITACIÓN DE HUMEDALES TIPO SISTEMA ESTUARINO”. Con dicho procedimiento las AC han logrado avanzar en el proceso de identificación de humedales, sobre todo el caso de las rías pues de conformidad al artículo 69 de la Ley de aguas N°276 su delimitación es necesaria en aras de determinar a su vez, la zona marítimo terrestre que se extiende a lo ancho de 200 metros del punto de ría identificado.No obstante lo anterior y respecto a la zona puntual de playa Sámara-Río Lagarto, se nota que existe una problemática que data de muchos años atrás y que presenta nuevas dificultades para el SINAC en cuanto a la labor de clasificación de humedales, sobre todo en cuanto a la identificación de manglares y esta situación se da porque el principal insumo que posee el SINAC para determinar si efectivamente hubo un cambio de uso de suelo eliminando este tipo de ecosistema y efectuando rellenos en su lugar, obedece al estudio de fotointerpretación facilitado por el IGN en el año 2019, mismo que refleja presunta cobertura arbórea que obedece al árbol de mangle antes de 1996 en sectores donde en la actualidad se verifican construcciones y rellenos. En esta misma línea de pensamiento, debe el SINAC destinar recursos económicos y humanos para poder efectuar los estudios de suelo con las herramientas y maquinarias aptas, siendo una labor que requiere planificación y tiempo para su consecución.Así mismo, se verifica la problemática de fincas inscritas a Nombre01 de privados y a Nombre01 de la Municipalidad en terrenos con posible afectación de patrimonio natural del Estado (humedales en ZMT), siendo necesario iniciar además los procesos de anulación de dichas fincas para su posterior inscripción a Nombre01 del MINAE (Artículo 13 de la Ley Forestal N°7575). Dado lo anterior, salta a la luz que la problemática que se presenta en el sector de playa Sámara- estero del Río Lagarto, obedece a una situación que data de hace aproximadamente 30 años y que el SINAC sí ha avanzado en las labores de identificación de humedales tal y como se verifica con la identificación de la Ría del Río Lagarto y la verificación de terrenos con presunta presencia de manglares en el pasado cuya cobertura empezó a eliminarse a partir del año 1996. Todavía se encuentra pendiente la resolución de algunos procesos en sede administrativa como en el caso del expediente 2011-01409-RIM que involucra a la finca 5-1558-Z (presuntamente inscrita en manglar), los procesos judiciales para declarar las nulidades de inscripción de dichas fincas y los posteriores procesos de restauración y rehabilitación de los ecosistemas con involucramiento de actores a lo interno de la institución y fuera de esta.
  4. 4Mediante escrito incorporado al expediente electrónico el 23 de febrero de 2023, Nelson Marin Mora, director regional del Área de Conservación Tempisque (ACT) del Sistema Nacional de Áreas de Conservación (SINAC), informa que: PRIMERO: Bajo el presente amparo, el recurrente indica: “(…) en el humedal y estero del río Lagarto de Playa Sámara, se están llevando a cabo obras de eliminación de humedales y manglar, así como rellenos que afectan áreas de alta fragilidad ambiental y Patrimonio Natural del Estado (…) Aduce que se requiere una inspección en campo para verificar los reclamos y proporcionar copias de los informes correspondientes. Además, se solicita la toma de medidas para resolver la situación denunciada, en cuenta el amojonamiento de las áreas de manglar, la restauración de los terrenos afectados y la coordinación con la Municipalidad de Nicoya para corregir la zonificación errónea (área compuesta por las fincas No. 502050001558Z, No. 502050091356 y No. 502050109521 en su Plan Regulador Costero)(…) SEGUNDO: En el registro de Sistema de Denuncias Ambientales ((SITADA), no consta denuncia en el sector mencionado al que hace referencia el denunciante, las denuncias en dicho sitio son recientes, mismas que son 43590-2023 y 44055-2023, con fecha del 26 de octubre del 2023 y del 21 de noviembre del 2023 , respectivamente.TERCERO: En lo que respecta a las acciones realizadas por parte de la Administración Forestal del Estado, representado por el Área de Conservación Tempisque (ACT) del Sistema Nacional de Áreas de Conservación (SINAC), se informa que se han realizado una serie de acciones para determinar el área que corresponde a un posible humedal en el sitio, mismas que se mencionan a continuación: En fecha 04 de abril del año 2019, mediante oficio DIG-TOT-0111-2019 se recibe de parte del señor Jonnathan Jiménez Zúñiga, coordinador del subproceso de Clasificación Territorial del Instituto Geográfico Nacional, Estudio Cartográfico y fotointerpretativo denominado “Estudio Fotointerpretativo Retrospectivo del Manglar Ubicado al Oeste del río Lagarto en Playa Sámara”, correspondiente al oficio DIG-TOT-INF-018-2019, elaborado por el Geógrafo. Giovanni Oconotrillo Chaves, Analista subproceso de Clasificación Territorial del Registro Nacional, Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional, mismo que se aporta en este acto de respuesta.Que en fecha 04 de marzo del año 2021, mediante oficio ACT-OR-DR-0274-21, el Biólogo Mauricio Mendez, funcionario del Área de Conservación Tempisque, determina la ría sobre Río Lagarto en Playa Sámara. Que en fecha 16 de junio del año 2021, mediante informe técnico ACT-OR–T–313-2021, emitido por el Topógrafo Fabian Bonilla Salguero, se emite criterio sobre la delimitación del humedal tipo sistema estuarino presente en la zona (estero-ría) en la desembocadura del río Lagarto, el cual concluye lo siguiente (…) La secuencia de fotografías muestra la degradación que sufrió el manglar a lo largo de las décadas, con una clara reducción de su área que se observa en las fotografías de los años 1945, 1989 y 1996, sin que se pueda precisar el momento histórico en que esto ocurrió. A partir de 1996, se observa que sobre el manglar se encuentra un relleno que terminó de modificar completamente su condición de humedal y de bosque de mangle, pues el relleno impide el ingreso de agua salada proveniente de las mareas y con ello, la regeneración natural (…).CUARTO: Que, en revisión del sistema de información catastral del registro nacional de la propiedad ( SIRI )de las áreas denunciadas en el recurso, es importante mencionar que estos terrenos se encuentran inscritos por el registro la finca número 502050109521 y concesiones 502050001558Z, 502050091356 por parte de la Municipalidad de Nicoya, por lo que se debe hacer acciones de des inscribir ante registro dichas propiedades y el cierre de las concesiones, para que el Área de Conservación Tempisque quien si tiene el interés de lograr una restauración, pero que sin embargo se debe de solventar jurídicamente con la anulación de esos números de finca para que procedamos a delimitar físicamente el humedal y realizar una propuesta de restauración considerando las nuevas condiciones del sitio, el cual ha tenido un cambio muy importante durante el paso de los últimos 30 años. QUINTO: Que una vez realizado el proceso legal administrativo mencionado en el apartado CUARTO, el Área de Conservación procederá a dar inicio con la presupuestación de los recursos para las labores técnicas de restauración del sitio, mediante un plan reparador del humedal para restaurar el ecosistema, a lo cual, el Área de Conservación iniciara con en la estrategia de restauración.
  5. 5Por memorial incorporado al expediente electrónico el 23 de febrero de 2023, el Ing. Alexander León Campos, director Área de Conservación Arenal Tempisque, refiere que playa Samara se encuentra fuera de la jurisdicción administrativa del Área de Conservación Arenal Tempisque y corresponde al Área de Conservación Tempisque, por tal razón no le es posible brindar el informe referido.
  6. 6Mediante escrito de fecha 27 de febrero de 2024, Carlos Armando Martínez Arias, Alcalde de Nicoya, informa que la denuncia ubica los hechos de “supuesta obras de eliminación de humedales y manglar, así como rellenos que afectan áreas de alta fragilidad ambiental y Patrimonio Natural del Estado”, asegurando que, tales hechos se presentan dentro de lo que el recurrente llama identificadores prediales número: 502050001558Z, 502050091357, 502050109521, es necesario resaltar que únicamente la primera corresponde a una finca ubicada en zona marítimo terrestre, y las otras 2 fincas corresponden a terrenos privadas inscritos en el Registro Nacional, y ajenos a la competencia de este municipio. Dichas fincas privadas se encuentran inscritas en el Registro Nacional bajo: el folio real 91356, plano catastrado número G-193418-2016, que tiene como propietario registral Bancol S.A., y folio real 109521, plano catastrado número G-1933416-2016, que tiene como propietario registral Corporación Hotelera Sámara S.A., respectivamente, según consulta efectuada a la base de Consultas Digital del Registro Nacional de la Propiedad.Con base en lo anterior, los hechos denunciados resultan ser competencia del IGN, ACAT, SINAC, MINAE dada su condición de ente cuya estructura organizacional y articulación funcional constituyen por mandato legal, la Administración de las zonas de humedal y manglar del Estado. Ahora bien, una vez delimitada las áreas de protección y/o conservación por parte de las autoridades competentes para ello, corresponde a este municipio el otorgamiento o no de concesiones, por ende, esta representación delimitará su respuesta a todo lo relacionado con la finca mencionada por el recurrente bajo el identificador predial número: 502050001558Z, que corresponde a la finca inscrita en el Registro Nacional, Bienes Inmuebles, Provincia de Guanacaste, bajo folio real número 1558-Z-000, plano catastrado G-0797618-1989, terreno de concesión de zona marítimo terrestre. SOBRE EL BIEN INMUEBLE BAJO FOLIO REAL Visto los reproches instaurados por el recurrente [mbre01 0 001], en el expediente No.24-003134-0007-CO, y dentro del ámbito de competencia, procedo a brindarle un informe en torno a la situación de la finca inscrita en concesión en la Provincia de Guanacaste, bajo la matrícula con relación a los hechos apuntados en la misma.Primero: La precitada concesión fue inscrita ante el Registro Nacional a fecha 03 de noviembre de 1989, bajo el plano catastro el , a re01 de de la sociedad denominada "Corporación Hotelera Samara Sociedad Anónima"; su vigencia expiró el 03 de noviembre de 2009, por lo que actualmente se encuentra en análisis de prorroga concesionaria y registrado bajo el identificador predial , conforme a la declaratoria de zona catastrada establecida mediante Decreto Ejecutivo No. 41678. Se adjunta Certificación literal de propiedad y plano de catastro. Que es finca ubicada espacialmente de la siguiente manera, tal y como se aprecia en el Sistema de Información Catastral (SIRI), https://siri.rnp.go.cr/SIRI/index.jsp: (…) Segundo: De acuerdo con la información del Registro Nacional de Humedales, disponible en el visor cartográfico del Registro Nacional http://www.snitcr.go.cr/Visor/index, sobre la finca inscrita en concesión en la Provincia de Guanacaste, bajo la matrícula , no se identifica o representa humedal alguno.Tercero: De acuerdo con la certificación ACT-OR-DR-144-14, emitida por el Sistema Nacional de áreas de Conservación, Área de Conservación Tempisque, referente a las áreas calificadas como Patrimonio Natural del Estado, el área total sobre el cual se ubica la finca inscrita en concesión en la Provincia de Guanacaste, bajo la matrícula , no se identifica o representa estero alguno. Se Adjunta certificación y mapa. Cuarto: El 10 de febrero de 2022, este Municipio a través de su Departamento de Gestión Ambiental, bajo el oficio MN-DPTSA-DGA-96- 2023, atiende la denuncia ambiental presentada por [1 001], 001], ligada a la propiedad , donde dicho departamento le señala lo siguiente: “1. A nivel de cartografía oficial del Instituto Geográfico Nacional de 1982-1983, (Hoja Garza, escala 1:50.000) no se representa humedal alguno en el sector analizado; pese a que la escala si lo permitía. Aunque eventualmente se pueden realizar estudios técnicos detallados, la Hoja Garza representa un dato oficial a considerar en toda denuncia por afectación a ecosistemas vulnerables. 2.Esta denuncia ambiental fue atendida hace dos décadas, llegándose al punto de agotar las vías administrativa y judicial. Como resultado se tiene en abril del 2004 la Sentencia N°29- 04 del Expediente 95-200090-390, y en septiembre del mismo año se declara sin lugar el recurso de casación, que fue solicitado por la Procuraduría General de la República. En dicho proceso judicial se sometió a análisis jurídico y valoración de la prueba, los detalles enumerados en su denuncia, presentada el 8 de abril del 2022. En razón de lo anterior, y con base en la Convención Americana de Derechos Humanos o Pacto de San José de Costa Rica, firmada el 22 de noviembre de 1969 y aprobada mediante la Ley 16 de 1972, Art. 8-4, según el cual “el inculpado absuelto por sentencia firme no podrá ser sometido a nuevo juicio por los mismos hechos”; y a nivel nacional, Constitución Política estipula en su artículo 42 que “Nadie podrá ser juzgado más de una vez por el mismo hecho punible”, no procede reiniciar un debido proceso administrativo con consecuencias penales, exactamente por el mismo hecho, en el mismo sitio.” El escrito líneas arriba transcrito y del cual se aporta copia, demuestra que esta corporación municipal ha sido respetuosa de los derechos del señor [01] al a 001] al atender el escrito presentando ante la Municipalidad sobre el objeto del presente proceso.Así las cosas, este Municipio a través de su Departamento de Zona Marítimo Terrestre al amparo del Principio de Publicidad Registral, mantiene la inscripción y análisis de la finca inscrita en concesión en la Provincia de Guanacaste, bajo la matrícula , hasta tanto la autoridad competente en la materia determine la existencia de humedal o estero alguno que nos permita excluir el sector del área concesionable e iniciar los procedimientos que sean necesarios según lo ordenado por la autoridad competente para ello.
  7. 7Por memorial de fecha 05 de marzo de 2024, el recurrente replica los informes rendidos y solicita se declare con lugar el recurso.
  8. 8Mediante escrito de fecha 06 de marzo de 2024, el señor Nombre02, solicita se le tenga como parte coadyuvante en el presente recurso y se declare con lugar en todos sus extremos.
  9. 9En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Hess Herrera; y,

Considerando:

I. DE PREVIO

De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción pues, se está ante una denuncia interpuesta ante el Área de Conservación Tempisque por una situación ambiental. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo

II. SOBRE LA SOLICITUD DE COADYUVANCIA PLANTEADA

La coadyuvancia es una forma de intervención procesal que se da cuando una persona actúa en un proceso adhiriéndose a las pretensiones de alguna de las partes principales. En consecuencia, está legitimado para actuar como coadyuvante quien ostente un interés directo en el resultado del recurso; empero, al no ser actor principal, el coadyuvante no resulta directamente afectado por la sentencia, es decir, la eficacia de esta no puede alcanzarle de manera directa e inmediata, ni le afecta la condición de cosa juzgada del pronunciamiento, aunque en materia de amparo pueda favorecerle la eficacia de lo resuelto debido al carácter de erga omnes de la jurisprudencia y precedentes de la jurisdicción constitucional (artículo 13 de la Ley de la Jurisdicción Constitucional). A partir de lo anterior y de conformidad con lo dispuesto en el artículo 34 de la Ley de la Jurisdicción Constitucional, se acepta la gestión planteada y se admite la coadyuvancia solicitada ante esta Sala

III. OBJETO DEL RECURSO

- Manifiesta el recurrente que, en el humedal y estero del río Lagarto de Playa Sámara, se están llevando a cabo obras de eliminación de humedales y manglar, así como rellenos que afectan áreas de alta fragilidad ambiental y Patrimonio Natural del Estado (área compuesta por las fincas No. 502050001558Z, No. 502050091356 y No. 502050109521 en su Plan Regulador Costero). Refiere que, el 8 de abril de 2022 se interpuso una denuncia ambiental ante el SINAC, en la que se requirió información, acciones correctivas, así como la delimitación y restauración de las áreas afectadas. Sin embargo, acusa que esta no ha sido resuelta por las autoridades competentes. Asimismo, reclama que, pese a dicha denuncia el gobierno local ha otorgado concesiones en la Zona Marítimo Terrestre (ZMT).

IV. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)El 04 de abril de 2019 el Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional mediante oficio DIG-TOT-0111-2019, remitió al Área de Conservación Tempisque el estudio cartográfico y fotointerpretativo denominado “Estudio Fotointerpretativo Retrospectivo del Manglar Ubicado al Oeste del río Lagarto en Playa Sámara”. (ver informe rendido por SINAC y prueba aportada).
  • b)El 04 de marzo del año 2021, mediante oficio ACT-OR-DR-0274-21, el Biólogo Mauricio Méndez, funcionario del Área de Conservación Tempisque, determinó la ría sobre Río Lagarto en Playa Sámara. (ver informe rendido por SINAC y prueba aportada).
  • c)El 16 de junio del año 2021, mediante informe técnico ACT-OR–T–313-2021, emitido por el Topógrafo Fabian Bonilla Salguero, se emite criterio sobre la delimitación del humedal tipo sistema estuarino presente en la zona (estero-ría) en la desembocadura del río Lagarto, el cual concluye lo siguiente: “Conclusión La secuencia de fotografías muestra la degradación que sufrió el manglar a lo largo de las décadas, con una clara reducción de su área que se observa en las fotografías de los años 1945, 1989 y 1996, sin que se pueda precisar el momento histórico en que esto ocurrió. A partir de 1996, se observa que sobre el manglar se encuentra un relleno que terminó de modificar completamente su condición de humedal y de bosque de mangle, pues el relleno impide el ingreso de agua salada proveniente de las mareas y con ello, la regeneración natural. El relleno que fue colocado sobre el área indicada por el IGN como correspondiente a manglar, se presume de varios cientos o quizás miles de metros cúbicos de material ya compactado, ya que si se analiza la figura 18 la extensión del manglar seria de 96482.37 m² aproximadamente, con un grosor de relleno de 0.5 m aproximado, el cual daría un área de material de 48241.18 m³, por lo que está gran cantidad de material está más allá del alcance del Área de Conservación, el retirar dicho material para realizar estudios de suelos que permitan obtener un estudio de suelos, insumo utilizado frecuentemente para determinar la extensión de humedales.

Esto debido a la inversión económica no determinada, pero sin duda muy cuantiosa, que se requeriría en maquinaria, personal y otros gastos asociados a remover ese relleno. En este sentido, el insumo técnicamente consiste y claro de que se dispone sobre la extensión original del manglar de la ribera oeste del Estero Lagarto, es el informe DIGTOT-0111-2019, elaborado por el IGN, ente competente en esta materia.” (ver informe rendido por SINAC y prueba aportada).

  • d)El 08 de abril de 2022 el amparado presentó -documento físico- ante el Área de Conservación Tempisque del Ministerio de Ambiente y Energía, denuncia ambiental por destrucción de manglar, humedales y petición de informe. (ver documentación aportada con el escrito de interposición).
  • e)Que según informa el SINAC, en la zona puntual de playa Sámara-Río Lagarto, existe una problemática que data de muchos años atrás, la cual, presenta dificultades para la identificación y clasificación de humedales; lo anterior, por cuanto el principal insumo que posee el SINAC para determinar si efectivamente hubo un cambio de uso de suelo eliminando este tipo de ecosistema y efectuando rellenos en su lugar, obedece al estudio de fotointerpretación facilitado por el IGN en el año 2019. De ahí que, se deben destinar recursos económicos y humanos para poder efectuar los estudios de suelo con las herramientas y maquinarias aptas, siendo una labor que requiere planificación y tiempo para su consecución. (ver informe rendido por SINAC y prueba aportada).
  • f)Que según informa el SINAC, se verifica la problemática de fincas inscritas a Nombre01 de privados y a Nombre01 de la Municipalidad en terrenos con posible afectación de patrimonio natural del Estado (humedales en ZMT), siendo necesario iniciar además los procesos de anulación de dichas fincas para su posterior inscripción a Nombre01 del MINAE (Artículo 13 de la Ley Forestal N°7575). (ver informe rendido por SINAC y prueba aportada).
  • g)Que según informa SINAC, se encuentra pendiente la resolución de algunos procesos en sede administrativa como en el caso del expediente 2011-01409-RIM que involucra a la finca 5-1558-Z (presuntamente inscrita en manglar), los procesos judiciales para declarar las nulidades de inscripción de dichas fincas y los posteriores procesos de restauración y rehabilitación de los ecosistemas con involucramiento de actores a lo interno de la institución y fuera de esta. (ver informe rendido por SINAC y prueba aportada).
  • h)Que las fincas 502050091357 y 502050109521 corresponden a terrenos privados, las cuales, se encuentran inscritas en el Registro Nacional bajo: el folio real 91356, plano catastrado número G-193418-2016, que tiene como propietario registral Bancol S.Nombre03., y folio real , plano catastrado número G-1933416-2016, que tiene como propietario registral Corporación Hotelera Sámara S.A., respectivamente. (ver informe rendido por la Municipalidad de Nicoya y prueba aportada).
  • i)Que la finca 502050001558Z, corresponde a la finca inscrita en el Registro Nacional, Bienes Inmuebles, Provincia de Guanacaste, bajo folio real número , plano catastrado G-0797618-1989, terreno de concesión de zona marítimo terrestre. (ver informe rendido por la Municipalidad de Nicoya y prueba aportada).
  • j)El 03 de noviembre de 1989 se inscribió ante el Registro Nacional la concesión, bajo el plano catastro el G-0797618-1989, a Nombre01 de la sociedad denominada "Corporación Hotelera Samara Sociedad Anónima"; su vigencia expiró el 03 de noviembre de 2009, por lo que actualmente se encuentra en análisis de prorroga concesionaria. (ver informe rendido por la Municipalidad de Nicoya y prueba aportada).
  • k)Que de acuerdo con la certificación ACT-OR-DR-144-14, emitida por el Sistema Nacional de áreas de Conservación, Área de Conservación Tempisque, referente a las áreas calificadas como Patrimonio Natural del Estado, el área total sobre el cual se ubica la finca inscrita en concesión en la Provincia de Guanacaste, bajo la matrícula , no se identifica o representa estero alguno. (ver informe rendido por la Municipalidad de Nicoya y prueba aportada).
  • l)El 10 de febrero de 2022 el Departamento de Gestión Ambiental del municipio accionado, mediante oficio MN-DPTSA-DGA-96-2023, brindó respuesta a la denuncia planteada por el amparado -ligada a la propiedad 5- 1558-Z-000-, en los siguientes términos: “1. A nivel de cartografía oficial del Instituto Geográfico Nacional de 1982-1983, (Hoja Garza, escala 1:50.000) no se representa humedal alguno en el sector analizado; pese a que la escala si lo permitía. Aunque eventualmente se pueden realizar estudios técnicos detallados, la Hoja Garza representa un dato oficial a considerar en toda denuncia por afectación a ecosistemas vulnerables. 2. Esta denuncia ambiental fue atendida hace dos décadas, llegándose al punto de agotar las vías administrativa y judicial. Como resultado se tiene en abril del 2004 la Sentencia N°29- 04 del Expediente [Valor 003], y en septiembre del mismo año se declara sin lugar el recurso de casación, que fue solicitado por la Procuraduría General de la República.

En dicho proceso judicial se sometió a análisis jurídico y valoración de la prueba, los detalles enumerados en su denuncia, presentada el 8 de abril del 2022. En razón de lo anterior, y con base en la Convención Americana de Derechos Humanos o Pacto de San José de Costa Rica, firmada el 22 de noviembre de 1969 y aprobada mediante la Ley 16 de 1972, Art. 8-4, según el cual “el inculpado absuelto por sentencia firme no podrá ser sometido a nuevo juicio por los mismos hechos”; y a nivel nacional, Constitución Política estipula en su artículo 42 que “Nadie podrá ser juzgado más de una vez por el mismo hecho punible”, no procede reiniciar un debido proceso administrativo con consecuencias penales, exactamente por el mismo hecho, en el mismo sitio.” (ver informe rendido por la Municipalidad de Nicoya y prueba aportada).

V. HECHO NO PROBADO

- No se tiene por demostrado el siguiente hecho de interés: Único) Que la autoridad recurrida haya brindado respuesta a la denuncia interpuesta por el recurrente el 08 de abril de 2022.

VI. SOBRE LAS ACTUACIONES DEL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN

- Manifiesta el recurrente que, en el humedal y estero del río Lagarto de Playa Sámara, se están llevando a cabo obras de eliminación de humedales y manglar, así como rellenos que afectan áreas de alta fragilidad ambiental y Patrimonio Natural del Estado (área compuesta por las fincas No. 502050001558Z, No. 502050091356 y No. 502050109521 en su Plan Regulador Costero). Refiere que, el 8 de abril de 2022 se interpuso una denuncia ambiental ante el SINAC, en la que se requirió información, acciones correctivas, así como la delimitación y restauración de las áreas afectadas. Sin embargo, acusa que esta no ha sido resuelta por las autoridades competentes.

De los informes rendidos por los representantes de la autoridad recurrida -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y del elenco probatorio, se tiene por acreditado que 04 de abril de 2019 el Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional mediante oficio DIG-TOT-0111-2019, remitió al Área de Conservación Tempisque el estudio cartográfico y fotointerpretativo denominado “Estudio Fotointerpretativo Retrospectivo del Manglar Ubicado al Oeste del río Lagarto en Playa Sámara”. Asimismo, se tiene que, el 04 de marzo del año 2021, mediante oficio ACT-OR-DR-0274-21, el Biólogo Mauricio Méndez, funcionario del Área de Conservación Tempisque, determinó la ría sobre Río Lagarto en Playa Sámara. De igual forma, se tiene que, el 16 de junio del año 2021, mediante informe técnico ACT-OR–T–313-2021, emitido por el Topógrafo Fabian Bonilla Salguero, se emite criterio sobre la delimitación del humedal tipo sistema estuarino presente en la zona (estero-ría) en la desembocadura del río Lagarto, el cual concluye lo siguiente: “Conclusión La secuencia de fotografías muestra la degradación que sufrió el manglar a lo largo de las décadas, con una clara reducción de su área que se observa en las fotografías de los años 1945, 1989 y 1996, sin que se pueda precisar el momento histórico en que esto ocurrió.

A partir de 1996, se observa que sobre el manglar se encuentra un relleno que terminó de modificar completamente su condición de humedal y de bosque de mangle, pues el relleno impide el ingreso de agua salada proveniente de las mareas y con ello, la regeneración natural. El relleno que fue colocado sobre el área indicada por el IGN como correspondiente a manglar, se presume de varios cientos o quizás miles de metros cúbicos de material ya compactado, ya que si se analiza la figura 18 la extensión del manglar seria de 96482.37 m² aproximadamente, con un grosor de relleno de 0.5 m aproximado, el cual daría un área de material de 48241.18 m³, por lo que está gran cantidad de material está más allá del alcance del Área de Conservación, el retirar dicho material para realizar estudios de suelos que permitan obtener un estudio de suelos, insumo utilizado frecuentemente para determinar la extensión de humedales.

Esto debido a la inversión económica no determinada, pero sin duda muy cuantiosa, que se requeriría en maquinaria, personal y otros gastos asociados a remover ese relleno. En este sentido, el insumo técnicamente consiste y claro de que se dispone sobre la extensión original del manglar de la ribera oeste del Estero Lagarto, es el informe DIGTOT-0111-2019, elaborado por el IGN, ente competente en esta materia.” Por parte, se tiene que, el 08 de abril de 2022 el amparado presentó -documento físico- ante el Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación (SINAC), denuncia ambiental por destrucción de manglar, humedales y petición de informe. Al respecto, según informa el SINAC, en la zona puntual de playa Sámara-Río Lagarto, existe una problemática que data de muchos años atrás, la cual, presenta dificultades para la identificación y clasificación de humedales; lo anterior, por cuanto el principal insumo que posee el SINAC para determinar si efectivamente hubo un cambio de uso de suelo eliminando este tipo de ecosistema y efectuando rellenos en su lugar, obedece al estudio de fotointerpretación facilitado por el IGN en el año 2019.

De ahí que, se deben destinar recursos económicos y humanos para poder efectuar los estudios de suelo con las herramientas y maquinarias aptas, siendo una labor que requiere planificación y tiempo para su consecución. Agregan que, se verifica la problemática de fincas inscritas a Nombre01 de privados y a Nombre01 de la Municipalidad en terrenos con posible afectación de patrimonio natural del Estado (humedales en ZMT), siendo necesario iniciar además los procesos de anulación de dichas fincas para su posterior inscripción a Nombre01 del MINAE (Artículo 13 de la Ley Forestal N°7575) y aducen que, se encuentra pendiente la resolución de algunos procesos en sede administrativa como en el caso del expediente 2011-01409-RIM que involucra a la finca 5-1558-Z (presuntamente inscrita en manglar), los procesos judiciales para declarar las nulidades de inscripción de dichas fincas y los posteriores procesos de restauración y rehabilitación de los ecosistemas con involucramiento de actores a lo interno de la institución y fuera de esta.

Pese a lo anterior, no se observan actuaciones por parte de la autoridad recurrida con posterioridad al informe técnico ACT-OR–T–313-2021 emitido el 16 de junio de 2021, así como tampoco, que le hayan brindado al recurrente respuesta sobre la denuncia planteada el 08 de abril de 2022.

Así las cosas, se acredita la lesión a los derechos fundamentales del amparado. Lo anterior, por cuanto se determina que la denuncia planteada por el recurrente en fecha 08 de abril de 2022, no ha sido resuelta por la autoridad recurrida. Ni siquiera constan acciones de su tramitación, ni que al tutelado se le haya puesto en conocimiento de las mismas, pues lo que se hace es un recuento de diligencias de los años 2019 y 2021 -con anterioridad a la denuncia-, fecha en la cual se emitió un informe técnico sobre la situación de la zona objeto de este recurso. Aunado a lo anterior, nótese que las autoridades del Sistema Nacional de Áreas de Conservación (SINAC), admiten la existencia de una problemática que data de muchos años atrás, la cual, presenta dificultades para la identificación y clasificación de humedales; lo anterior, por cuanto el principal insumo que posee el SINAC para determinar si efectivamente hubo un cambio de uso de suelo eliminando este tipo de ecosistema y efectuando rellenos en su lugar, obedece al estudio de fotointerpretación facilitado por el IGN en el año 2019.

En ese sentido, se limitan a indicar que se deben destinar recursos económicos y humanos para poder efectuar los estudios de suelo con las herramientas y maquinarias aptas, siendo una labor que requiere planificación y tiempo para su consecución, más no se señalan acciones concretas ya sean a corto, mediano o largo plazo, para determinar la situación real de la problemática denunciada y brindar una solución definitiva. Por lo expuesto, se declara con lugar el recurso en los términos que se indican en la parte dispositiva.

VII. SOBRE LAS ACTUACIONES DE LA MUNICIPALIDAD ACCIONADA

Reclama el accionante que, pese a dicha denuncia el gobierno local ha otorgado concesiones en la Zona Marítimo Terrestre (ZMT). De los informes rendidos por los representantes de la autoridad recurrida -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y del elenco probatorio, se tiene por acreditado que, las fincas 502050091357 y 502050109521 corresponden a terrenos privados, las cuales, se encuentran inscritas en el Registro Nacional bajo: el folio real 91356, plano catastrado número G-193418-2016, que tiene como propietario registral Bancol S.A., y folio real 109521, plano catastrado número G-1933416-2016, que tiene como propietario registral Corporación Hotelera Sámara S.A., respectivamente. Por su parte, la finca 502050001558Z, corresponde a la finca inscrita en el Registro Nacional, Bienes Inmuebles, Provincia de Guanacaste, bajo folio real número 1558-Z-000, plano catastrado G-0797618-1989, terreno de concesión de zona marítimo terrestre.

Sobre dicho terreno, se tiene que, el 03 de noviembre de 1989 se inscribió ante el Registro Nacional la concesión, bajo el plano catastro el G-0797618-1989, a Nombre01 de la sociedad denominada "Corporación Hotelera Samara Sociedad Anónima"; su vigencia expiró el 03 de noviembre de 2009, por lo que actualmente se encuentra en análisis de prorroga concesionaria. Finalmente, se tiene que, el 10 de febrero de 2022 el Departamento de Gestión Ambiental del municipio accionado, mediante oficio MN-DPTSA-DGA-96-2023, brindó respuesta a la denuncia planteada por el amparado -ligada a la propiedad 5- 1558-Z-000-, en los siguientes términos: “1. A nivel de cartografía oficial del Instituto Geográfico Nacional de 1982-1983, (Hoja Garza, escala 1:50.000) no se representa humedal alguno en el sector analizado; pese a que la escala si lo permitía. Aunque eventualmente se pueden realizar estudios técnicos detallados, la Hoja Garza representa un dato oficial a considerar en toda denuncia por afectación a ecosistemas vulnerables. 2.

Esta denuncia ambiental fue atendida hace dos décadas, llegándose al punto de agotar las vías administrativa y judicial. Como resultado se tiene en abril del 2004 la Sentencia N°29- 04 del Expediente [Valor 003], y en septiembre del mismo año se declara sin lugar el recurso de casación, que fue solicitado por la Procuraduría General de la República. En dicho proceso judicial se sometió a análisis jurídico y valoración de la prueba, los detalles enumerados en su denuncia, presentada el 8 de abril del 2022. En razón de lo anterior, y con base en la Convención Americana de Derechos Humanos o Pacto de San José de Costa Rica, firmada el 22 de noviembre de 1969 y aprobada mediante la Ley 16 de 1972, Art. 8-4, según el cual “el inculpado absuelto por sentencia firme no podrá ser sometido a nuevo juicio por los mismos hechos”; y a nivel nacional, Constitución Política estipula en su artículo 42 que “Nadie podrá ser juzgado más de una vez por el mismo hecho punible”, no procede reiniciar un debido proceso administrativo con consecuencias penales, exactamente por el mismo hecho, en el mismo sitio.” Así las cosas, se descarta la lesión a los derechos fundamentales del tutelado.

Se determina que, de las tres propiedades identificadas por el amparado en el escrito de interposición, sólo la finca 502050001558Z, corresponde a terreno de concesión de zona marítimo terrestre, el cual, fue inscrito bajo esa naturaleza desde el año 1989. De igual forma, se tiene que la vigencia de la concesión otorgada expiró en el año 2009 y actualmente se encuentra en análisis la prórroga concesionaria. Es decir, el reclamo del recurrente versa sobre un futuro hecho e incierto, pues el municipio accionado aún no ha determinado si procede o no prorrogar la concesión del terreno. Por otra parte, véase que desde el 10 de febrero de 2022 el Departamento de Gestión Ambiental del municipio accionado, comunicó al amparado que la denuncia por afectación a ecosistemas vulnerables de la propiedad 5- 1558-Z-000 ya había sido resuelta en vía judicial bajo el expediente No. [Valor 003]. De ahí que, no se observan acciones u omisiones por parte del ente municipal que ameriten la intervención de la Sala. Ergo, este extremo del recurso debe desestimarse, como en efecto se hace.

IX. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

X. VOTO SALVADO DEL MAGISTRADO SALAZAR ALVARADO

Con el debido respeto, disiento del voto de mayoría que declara parcialmente con lugar el recurso, con base en las siguientes razones:

La protección a un ambiente sano y ecológicamente equilibrado, en el Ordenamiento Jurídico Costarricense, está tutelado no solo en el artículo 50, de la Constitución Política, sino también en una serie de leyes y decretos ejecutivos (reglamentos) vigentes, tales como la Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; la Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; y el Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), para citar solo algunos. Esto hace necesario, en materia ambiental, separar el control de constitucionalidad del control de legalidad. En este sentido, es criterio del suscrito que esta Sala, por vía de amparo, solo debe conocer un asunto en que se alega violación al derecho a un ambiente sano y ecológicamente equilibrado, si la Administración no ha intervenido aún y cuando la violación a ese derecho sea manifiesta y evidente, de fácil constatación, de cierta importancia o gravedad y que afecte, de forma directa, a alguna persona o comunidad en concreto.

De lo contrario, el tema debe plantearse y discutirse en la vía de legalidad. Por ello, el simple incumplimiento de obligaciones y deberes impuestos legalmente a las diversas administraciones públicas en materia ambiental es propio de ser conocido en la vía de legalidad –administrativa o jurisdiccional-, donde, con mucha mayor amplitud, podrán fiscalizarse los incumplimientos u omisiones que se acusen. Debe tenerse presente que el recurso de amparo es un proceso sumario, informal, sencillo y rápido, de manera tal, que desde el momento mismo en que la Administración interviene en un asunto ambiental, en ejercicio de sus competencias, y sustancia un procedimiento, con el dictado de actos administrativos, su conocimiento resulta ajeno al ámbito de acción de esta jurisdicción especializada. Por ello, la revisión de las actuaciones administrativas llevadas a cabo en torno a un tema ambiental que requiera, para su correcta valoración, de un proceso de conocimiento pleno, solo es posible en la jurisdicción ordinaria, toda vez que el diseño del proceso de amparo es incompatible con la contrastación o revisión de criterios técnicos o jurídicos elaborados al amparo de las normas legales o reglamentarias vigentes o con la evacuación de nuevos y mayores elementos de convicción necesarios para la contrastación o revisión de los criterios que ya consten en el expediente administrativo del caso.

Lo contrario implicaría transformar el amparo en un proceso ordinario de pleno conocimiento, con lo cual se desnaturalizaría y se tornarían nugatorios los fines para los cuales ha sido diseñado, con lo cual, perdería su condición de instrumento para la tutela eficaz de los derechos fundamentales. Como consecuencia de lo anterior, estimo que cuando un ente u órgano público ha intervenido, en diversas formas, o ha dictado actos administrativos en relación con un asunto ambiental, su conocimiento y fiscalización corresponde a la jurisdicción de lo contencioso-administrativo. Es, precisamente, la verificación de la existencia de esa intervención administrativa lo que determina que el asunto sea competencia de la vía legalidad. En consecuencia, este recurso debió haberse rechazado de plano, ya que su objeto es una cuestión propia de ser discutida, analizada y resuelta en la vía de legalidad. Empero, como no se hizo así, lo procedente es declararlo sin lugar, sin hacer pronunciamiento alguno con respecto al fondo de la cuestión planteada por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.

XI. VOTO SALVADO PARCIAL RESPECTO A LA PARTE DISPOSITIVA DE ESTA SENTENCIA DE LA MAGISTRADA GARRO VARGAS

Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, en concreto, a la orden dada en el punto b) de esta sentencia para que, en el plazo de doce meses, se realicen estudios para determinar la situación real de la problemática denunciada objeto de este recurso y sea brindada una solución definitiva. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

XI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara con lugar el recurso, únicamente en contra del Sistema Nacional de Áreas de Conservación. Se ordena a David Chavarría Morales, director ejecutivo a.i y a Nelson Marín Mora, director regional del Área de Conservación Tempisque (ACT), ambos del del Sistema Nacional de Áreas de Conservación (SINAC), para que dentro del ámbito de sus competencias: a) adopten y giren las acciones necesarias, para que en el plazo de UN MES a partir de la notificación de esta sentencia, se brinde respuesta como corresponda a la denuncia planteada por el recurrente en fecha 08 de abril de 2022 y se le comunique lo resuelto; b) Asimismo, realizar las acciones y coordinaciones pertinentes, para que en el plazo de DOCE MESES contados a partir de la notificación de esta sentencia, se efectúen los estudios necesarios y que correspondan a fin de determinar la situación real de la problemática denunciada y brindar una solución definitiva.

Lo anterior, bajo el apercibimiento que con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quienes recibieren una orden que deban cumplir o hacer cumplir, dictada en un recurso de amparo y que no la cumplieren o no la hicieren cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto a la Municipalidad de Nicoya, se declara sin lugar el recurso. El magistrado Castillo Víquez consigna nota. El Magistrado Salazar Alvarado salva el voto y declara sin lugar el recurso, por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.

La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia, en lo referente a orden dada en el punto b) y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
