The Chamber denied the amparo because AyA maintained supply through pipes and tanker trucks, was implementing a permanent solution, and the alleged inequality was not proven, with a dissent favoring a request for an ARESEP report.

SummaryResumen

The Constitutional Chamber denied an amparo filed by a San José de Alajuela resident challenging the prolonged absence of a permanent solution to local water shortages, reliance on tanker-truck deliveries, and the progress of the El Pasito Aqueduct improvement project. The majority found that service interruptions resulted from topographic, hydraulic, and demand-related conditions rather than arbitrary conduct by the Costa Rican Institute of Aqueducts and Sewers. It also determined that AyA was implementing a BCIE-financed project intended to resolve the problem permanently, supplying the community daily through tanker trucks, and providing piped water to the claimant’s residence during the months reviewed. Because the claimant did not establish an actual denial of water service or specify the alleged unequal treatment, the Chamber found no constitutional violation. Justice Rueda Leal dissented, reasoning that the proceeding should continue so ARESEP could report on infrastructure investment, unaccounted-for water losses, and the utility’s capacity to execute the necessary projects.

Key excerptExtracto clave

In that regard, it should be noted that the claimant does not allege a lack of water supply per se, but rather expresses dissatisfaction with the progress of the project works and the manner in which water is distributed, without specifying what the alleged inequality consists of; moreover, it has been demonstrated in this proceeding that the claimant receives service at her residence. Based on the foregoing, the appeal must be denied. Therefore: The appeal is denied. Justice Rueda Leal dissents and orders that the proceeding continue so that a report may be requested from the General Regulator of the Regulatory Authority for Public Services.

Document Review Case File: 24-008620-0007-CO Decision No. 2024013303 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty on diecisiete de mayo de dos mil veinticuatro.

Amparo proceeding (recurso de amparo) processed under case file No. 24-008620- 0007-CO, filed by [Nombre01 001], identity card [CED01], against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Findings:

  1. 1In a written submission entered into this Court’s Online Management System on 03 de abril de 2024, the petitioner filed an amparo proceeding against the Instituto Costarricense de Acueductos y Alcantarillados. She states that, since 2012, the community of Dirección01 in San José de Alajuela has experienced water shortages, even though the provider is ICAA. In 2012, a project financed through a loan from the Banco Centroamericano de Integración Económica (BCIE) was announced to resolve the situation; however, that project never materialized, and they do not know why. She states that, as a result of a prior proceeding, this Chamber ordered ICAA to supply water by tanker trucks while the project was being carried out; nevertheless, the project has still not been implemented, and it has been reported that its execution is scheduled for the III trimestre de 2026, which would entail a 14-year wait for a solution. She further asserts that the tanker-truck measure is inequitable, inhumane, and unfair. She also maintains that the tanker trucks are insufficient to supply everyone, that the water collected is unsafe for consumption, and that storage in containers has caused public-health problems, such as the proliferation of dengue fever. She states that ICAA attributes the lack of water to climatic phenomena and topography, which the community disputes because other nearby areas receive a normal supply. She argues that the real problem lies in the poor distribution of water and that ICAA continues assigning water connections (pajas de agua) to other projects without resolving the problem in Dirección01. She requests that the project’s implementation date be brought forward and that the regular piped water supply be restored during the night, which would allow the tanks to be filled without relying on tanker trucks. This would also ensure an equitable and safe supply until the permanent project is completed. Based on the foregoing, she applies to the Chamber for protection of the protected party’s fundamental rights and requests that the proceeding be granted.
  2. 2In a written submission dated 08 de mayo de 2024, Johnny Rodríguez Alvarado, head of the Alajuela Cantonal Office of the Instituto Costarricense de Acueductos y Alcantarillados, Región Central Oeste, reports as follows: I. REGARDING THE FACTS ALLEGED BY THE PETITIONER. Based on technical report No. GSP-RC-A-2024-00157 dated 7 de mayo del 2024, prepared by Lic. Johnny Rodríguez Alvarado, an official of the Cantonal de Acueductos y Alcantarillados en Alajuela, which is submitted as evidence and forms an integral part of the administrative record (expediente administrativo), it has been established that: 1. The drinking-water system known as CO-A-01 Acueducto El Pasito, which supplies Dirección01, Barrio San José, Distrito San José, Cantón Alajuela, experiences shortages due to both its high topographic location and the aqueduct’s hydraulic conditions. The problem worsens during the dry season because the sources and wells substantially reduce their output.(See technical report No. GSP-RC-A-2024-00157 dated 7 de mayo del 2024 of the Cantonal de Acueductos y Alcantarillados en Alajuela.) 2. In pursuit of a permanent solution to improve the drinking-water supply and continuity of drinking-water service for the areas supplied by Acueducto CO-A-01 El Pasito, feasibility and design studies were conducted in 2013 through an external consultancy as part of the investment program known as BCIE 2164. The Institution was able to obtain financing for the execution of the works in 2018, when Project 001563, Improvements to the Pasito de Alajuela Aqueduct System, Stage II, financed by the Banco Centroamericano de Integración Económica, was approved. The project has several stages and a completion date of III trimestre del año 2026. Because the project’s supply sources depend on drilling wells, several have been drilled, some of which did not prove suitable, despite the drilling having been contracted.Consequently, in 2019, the decision was made to divide the project into two stages so that the components that did not depend on land or on drilling wells could be executed as soon as possible. Subsequently, as time has elapsed, the Juan León and Coyol wells have already been drilled; the land for access to and complementary works for the Pozo Juan León is being purchased; archaeological studies are also being conducted so that the designs can proceed; and existing plans are being revised. (See technical report No. GSP-RC-A-2024-00157 dated 7 de mayo del 2024 of the Cantonal de Acueductos y Alcantarillados en Alajuela.) 3. In response to this problem and in compliance with the Constitutional Chamber’s order in judgment (voto) number 2020-16425, the Cantonal AyA Alajuela distributes water every day by tanker truck to the areas affected by shortages, including Dirección02 de Alajuela, alternating water deliveries to the affected areas every other day as a temporary relief measure. It fills water-storage tanks at properties that have them, while those without storage tanks are supplied using the containers they bring to the tanker truck. Each user is solely responsible for handling and storing the water so as to prevent contamination, since the water distributed by tanker truck is drinking water. (See technical report No. GSP-RC-A-2024-00157 dated 7 de mayo del 2024 of the Cantonal de Acueductos y Alcantarillados en Alajuela.) 4. It is relevant to note in this section that, according to information duly entered in the OPEN SCI Institutional Commercial System, service NIS [Valor 002], billed under the petitioner’s Nombre01, [Nombre01 001], has received piped drinking-water service, since the water meter records consumption during enero, febrero, marzo y abril 2024. (See technical report No. GSP-RC-A-2024-00157 dated 7 de mayo del 2024 of the Cantonal de Acueductos y Alcantarillados en Alajuela.)
  3. 3In a submission dated 09 de mayo de 2024, Juan Manuel Quesada Espinoza, executive president of the Instituto Costarricense de Acueductos y Alcantarillados, reports in the same terms as the Alajuela Cantonal Office of the Instituto Costarricense de Acueductos y Alcantarillados, Región Central Oeste.
  4. 4In a written submission entered into the electronic case file on 14 de mayo de 2024, the petitioner reiterates her arguments.
  5. 5The statutory requirements have been observed in the proceedings conducted.

Justice Hess Herrera is the authoring judge; and,

Considering:

I. SUBJECT MATTER OF THE PROCEEDING

- The petitioner states that, in 2012, a project was announced to resolve the water-supply problems affecting the community of Dirección01 in San José de Alajuela. She states that, as a result of a prior proceeding, this Chamber ordered ICAA to supply water by tanker trucks while the project was being carried out; nevertheless, the project has still not been implemented. She maintains that the tanker-truck measure is inequitable, inhumane, and unfair. She requests that the project’s implementation date be brought forward and that the regular piped water supply be restored during the night, which would allow the tanks to be filled without relying on tanker trucks.

II. PROVEN FACTS

For purposes of deciding this matter, the following facts are deemed duly established, either because they have been proven or because the respondent failed to address them as required by the initial order:

  • a)The petitioner is a resident of Dirección01, in San José de Alajuela (undisputed fact).
  • b)The drinking-water system known as CO-A-01 Acueducto El Pasito, which supplies Dirección01, Dirección03, Distrito San José, Cantón Alajuela, experiences shortages due to both its high topographic location and the aqueduct’s hydraulic conditions. The problem worsens during the dry season because the sources and wells substantially reduce their output. (See report submitted and evidence provided.)
  • c)ICAA is implementing the “Proyecto de Mejoras del Acueducto El Pasito,” under the responsibility of the Unidad Ejecutora de Acueductos y Alcantarillados and financed by the Banco Centroamericano de Integración Económica. (See report submitted and evidence provided.)
  • d)ICAA distributes water every day by tanker truck to the areas affected by shortages, including Dirección01, in San José de Alajuela. (See report submitted and evidence provided.)
  • e)Memorandum No. GPS-RC-A-2024-00117, “Subject: Updated Report on Improvements to Acueducto CO-A-01 El Pasito de Alajuela, as of marzo 2024,” explains the project’s current status as follows: “(…) The project is currently in the final design stage. Archaeological studies are being conducted at one well site so that the designs can proceed, and, additionally, work is being carried out jointly with SAID to revise existing plans. The following dates are currently established for this project: BPIP 00156 3-2, Project for Improvements to the Pasito de Alajuela Aqueduct System (Stage II), Upload to SICOP 15/05/2024, Award 29/10/2024, Start of Works 29/11/2024, and Completion of Works 30/11/2025. However, there is a risk that not all the studies required to advance from the final design stage to bidding will be available within the scheduled timeframe.” (sic) (See report submitted and evidence provided.)
  • f)According to the OPEN SCI Institutional Commercial System, service NIS [Valor 002], billed under the petitioner’s Nombre01, [Nombre01 001], has received piped drinking-water service, since this water meter records consumption during enero, febrero, marzo y abril 2024. (See sworn report submitted and evidence provided.)

III. RELEVANT PRECEDENT

- In judgment No. 2023008941 issued at 09:20 on 21 de abril de 2023, this Chamber ruled on the water-shortage problem in the community of Dirección01 in San José de Alajuela and the project being developed by ICAA in that locality, holding, insofar as relevant:

“III.- Regarding the specific case. In the case at hand (sub lite), the petitioner alleges that the community of Calle Moreira in San José de Alajuela has experienced water shortages for decades. He complains that, as a temporary relief measure, tanker trucks have been sent to refill the affected residents’ containers. He alleges that the trucks appear unsanitary and that the operators do not ensure compliance with hygiene measures during distribution. He further states that ICAA required each house to install a pipe to which the tanker truck could connect its hose to supply each household’s tanks, a measure he considers unfair because some residents lack the financial resources to construct such installations. He complains that BCIE provided funding to improve the water supply in 2012; nevertheless, no genuine solution to the problem has been implemented.

Prima facie, it must be noted that the problem alleged by the petitioner concerning water shortages in barrio San José de Alajuela has been considered by this Chamber on several occasions.

Recently, in judgment no. 2022016425 at 9:20 a.m. on 15 de julio de 2022, this Court ruled:

“III.- REGARDING THE SPECIFIC CASE. In the case under review (sub examine), the claimant alleges that, since 2012, she has been monitoring an ICAA project that would purportedly resolve the water shortage in the district of San José de Alajuela, specifically in Dirección01. She explains that no progress has been observed and that, on the contrary, water-supply problems in the area worsen each day, while service interruptions are becoming more frequent and lasting longer, as occurred between el 6 y el 11 de junio de 2022. She states that the ICAA reported that the project intended to resolve the alleged problem would not be completed until 2027. She requests that the ICAA provide a permanent solution to the problem affecting her community, particularly given that the shortage is not as severe in neighboring areas. She maintains that sending water tanker trucks as a palliative measure whenever service interruptions are detected has led the ICAA to use them more frequently, and she therefore questions the contract between that institute and the company that owns those trucks.

In this matter, it has been established that the petitioner resides in San José de Alajuela. It has also been confirmed that the first phase of the project “Mejoras al Sistema de Abastecimiento de Agua Potable El Pasito de Alajuela” was completed in August 2012. In this regard, it is noted that “The primary scope of this project was to increase the water capacity of the Sistema El Pasito de Alajuela by drilling the wells now known as ‘Pozo Cacique 4’ and ‘Pozo Cacique 5,’ whose output is conveyed to the ‘tanque Cacique’ and subsequently pumped again through a 250mm HD (ductile iron) force main to the tanque Borbón, which in turn supplies the areas of Villa Bonita, Montecillos, Dirección03 and Coyol de Alajuela.” The Chamber notes that, on 28 de enero de 2014, an ICAA official sent emails to the petitioner stating: “Good afternoon, Mrs. Mrs. (sic) Nombre02: The Proyecto de Mejoras al Pasito is the project that AyA has to improve the Zona de Presión del Borbón, which includes the Sector de Barrio San José de Alajuela.

As previously indicated, all necessary actions are being taken so that the project may begin operating as soon as possible.” And also: “Good morning, Mrs. Nombre02, attached is the response provided to us by Mr. Norman Artavia, who is responsible for the electromechanical division of the Región Central Oeste, explaining why the Proyecto de Mejoras has not yet been put into operation: Hello Nombre03 The cited project has not (sic) been put into operation for the following reason: The 500 Kvar pad-mounted transformer has not been energized because it must be delivered to ICE, together with the operational 300 Kvar transformer. The latter has been operating for approximately 2.5 years. During an inspection performed by ICE technical personnel, they found some (sic) internal deficiencies, and the procedures were therefore suspended. Arrangements are being made to rent another transformer of the same type so that the 500 Kvar transformer can be energized and the operational tests can be performed with the company INTEK.

Today, the requested information is being submitted at the Plantel La Maravilla del ICE so that the rental and installation of the equipment may proceed. We are awaiting completion of the foregoing so that the Automatic Recloser and the 500 Kvar transformer may be officially accepted, leaving the repair or replacement of the 300 Kvar transformer pending. Note: This Unit is following up on this matter in order to place the project ‘Mejoras Pasito’ into operation. Kind regards.” It has likewise been confirmed that the project known as “Mejoras al Sistema El Pasito de Alajuela, Etapa II” is included under BCIE loan 2164, relating to project 001563. The works to be carried out through that project are necessary to replace the existing pipelines in Dirección03; in addition, a 2600m3 storage tank is to be constructed. The Chamber further verifies that the drinking-water service provided by the ICAA in barrio San José de Alajuela is subject to hourly interruptions between 6:00 and 23:00, which is why alternative means are used, such as sending tanker trucks between 7:00 and 14:00, Monday through Sunday.

It has also been established that, on 4 de junio de 2022, an ICAA official sent an email to other employees of that institute stating: “At approximately 17:00 on Saturday 4 de junio del 2022, multiple reports were received from high-elevation areas of Sistema CO-A-01 El Pasito de Alajuela, which are served by the Cacique - Borbón pressure zone through the tanks bearing those same names; the localities included in those reports were Villa Bonita, Lotes Solís, Dirección03 and El Coco (Santiago Oeste). Personnel from the electromechanical maintenance department proceeded to inspect the equipment and identified a failure in the equipment at pozo Cacique 4 that prevents it from restarting operations, which is why the equipment must be removed in order to determine the precise location of the detected failure. Until this water source (COA01AP025) is put back into operation, the Cacique - Borbón pressure zone of Sistema El Pasito de Alajuela has 24% less output (93 Litros por segundo), and under these conditions it is impossible to maintain the level of tanque Cacique, both to serve the area supplied by this storage facility and to operate the Cacique - Borbón booster pumping system, which directly affects the second storage facility and, of course, the areas identified above.

Due to the foregoing and the weekend demand pattern, both tanks recorded levels of 0,00 metros, a situation that remains practically unchanged at this time (see the following image showing the level of tanque Borbón) and entails an interruption of service in the specified sectors, which will continue until the aforementioned water source is returned to operation (…) In light of this situation, overtime is being authorized for personnel of the Unidad Cantonal de Alajuela, who, beginning at 06:30 on Sunday 5 de junio, will assist in supplying water by alternative means (tanker trucks). Appropriate follow-up will be conducted according to the availability of the equipment essential for removing the equipment from pozo Cacique 4.” Accordingly, the Court finds that, between 4 and 8 de junio de 2022, sistema CO-A-01 El Pasito experienced a technical and operational imbalance that caused interruptions in the provision of drinking-water service in the areas supplied by the tanques Cacique and Borbón, “which was caused by a sudden, unscheduled failure of the pumping equipment at the well known as pozo Cacique 4, a water source that accounts for 24% of the drinking-water output for human consumption of Sistema CO-A-01 El Pasito de Alajuela.” Consequently, the ICAA sent its own and rented tanker trucks to the affected areas to guarantee a minimum subsistence supply.

For his part, on 13 de junio de 2022, the ICAA general manager informed the petitioner by email that: “(…) I confirm receipt of your email concerning the service deficiencies in Dirección01 in Alajuela. I would appreciate it if you would confirm the exact address of your residence or provide us with a service number (NIS) so that we can locate the site and analyze the problem affecting you. I also wish to inform you that BCIE financing is being used for several dozen projects throughout the country, in places such as Sarapiquí, Puerto Viejo, Bagaces, Golfito, and others. Once we have confirmed your location, we can determine whether any of the investment projects include an improvement to service at your place of residence. Unfortunately, we have had several incidents that have affected service in Barrio San José: failures at pozo del Cacique, damage from lightning strikes last weekend, and even the fire at the cardboard factory, where large quantities of water were consumed, resulting in rationing.

I can confirm that we are not diverting water to zona franca Coyol in a manner that affects residential service; those operations have been due to temporary and exceptional circumstances. Regarding new construction, its authorization or inspection is not the responsibility of AyA; that is a municipal function. We will, of course, investigate possible illegal connections and remedy their impact on service availability. Finally, I requset (sic) that, if you wish us to contact you, please update your telephone number, as it is missing one digit (…)” In view of the foregoing, this Court deems it necessary to clarify that the problem alleged by the claimant concerning the water shortage suffered by residents of barrio San José de Alajuela has been considered by this jurisdiction on several occasions. In this regard, in judgment no. 2022008784 at 9:20 a.m. on 22 de abril de 2022, this Chamber ruled:

III. REGARDING THE SPECIFIC CASE

In the case at bar (sub lite), the appellant alleges that the ICAA carries out arbitrary and unlawful interruptions of the water supply in barrio San José de Alajuela, with the result that, on most days, residents are without that service for more than 10 hours. She contends that complaints have been filed for years, yet no effective solution has been implemented. She asserts that the ICAA intends to resolve the problem by sending tanker trucks, but they do not always arrive, causing portions of the district to remain without coverage. She requests that Instituto Costarricense de Acueductos y Alcantarillados make the investment necessary to supply water to the district of San José de Alajuela. She asks that, if the ICAA cannot provide them with water service, it be provided by another organization, such as Municipalidad de Alajuela.

A review of the case record shows that the appellant is a resident of San José de Alajuela. It has also been confirmed that, since 2012, residents of San José de Alajuela have submitted various petitions to Instituto Costarricense de Acueductos y Alcantarillados, Municipalidad de Alajuela and Defensoría de los Habitantes de la República, to cite a few examples, concerning the problem relating to the provision of water service in that locality.

The Chamber observes that, on 8 de febrero de 2022, the Región Central Oeste of ICAA issued memorandum SG-GSP-RC-2022-00091, which states: “SECOND: That the matters asserted by the appellants in the filing admitted by the Sala Constitucional are confined to the geographical area known as Dirección04, also referred to as the Buenos Aires sector or ‘El Triángulo,’ an area in which this Region, within the jurisdiction of the Unidad Cantonal de Alajuela, has undertaken all actions falling within its operational and service-provision authority that are necessary to guarantee this population access to drinking water; therefore, the assertion that the pipes are completely devoid of this vital resource is untrue. On the contrary, the current situation corresponds to the factual circumstances supported by the technical and scientific information obtained by the Institute through automatic pressure recorders installed at the same monitoring points in the area (see Figure 1), which have previously been reported both to the Honorable Chamber and to the Defensoría de los Habitantes and which conclusively disprove the assertion contained in the filing submitted by the appellants (…) THIRD: That the relief sought by the appellants before the Judiciary is not only being provided by the Región Central Oeste as ordered by the judgment of the Sala Constitucional, but is also subject to strict periodic monitoring to determine whether the scheduling, deployment, and dispatch of alternative supply methods (tanker trucks) is warranted when interruptions in service exceed eight (8) hours.

This situation is shown in the graphs for the aforementioned monitoring points (see Figure 2), which, for the 2022 dry season (periodo de estiaje), have confirmed the persistence of hourly service interruptions in the following sectors: the upper portion of Dirección04 (Dirección05, ‘El Triángulo,’ or Buenos Aires), Dirección06 (upper sector of Fábrica de Tubos Campeón), and the upper sector of Dirección07. According to the records from monitoring points NIS 2001790, NIS 2000837, and NIS 2001727, the interruption in these areas extends from 06:00 hours until 23:00 hours each day (see Figure 2) (…) FOURTH: That the graph shown in Figure 2 confirms that, except for these 3 upper sectors, the defined geographical area subject to periodic review does not experience service interruptions, although it clearly exhibits a dynamic variation that decreases below the minimum dynamic service-pressure limit (10 m.c.a.), represented on the graph by the red transverse line at the value 10 on the vertical scale, and even below the functional service pressure as well (except for NIS 2001869), represented by the red transverse line at the value 7,5 on the vertical scale of the graph in Figure 2.

FIFTH: It is appropriate to inform the Honorable Chamber that the dynamic condition and behavior depicted in the graphs correspond to a natural characteristic of drinking-water distribution systems: during daytime hours, pressure decreases in direct relation to demand and consumption, while it increases during nighttime hours as a result of reduced consumption by the user population. Consequently, the conditions depicted in the graph in Figure 2 are not the result of any arbitrary action by the Institute. To date, actions have been undertaken and substantial efforts made to maintain continuous service through the water-supply system (sistema de acueducto), which, as previously reported in this particular case, depends on the so-called ‘Tanque Borbón.’ As shown in Figure 3, and unlike in prior years, that tank maintains an optimal storage level, since it generally remains at a height of 3 metros, equivalent to a volume of un millón doscientos mil litros of water for human consumption (1 200m³).

Nevertheless, this is insufficient to guarantee continuous service to all users in the area served by this tank, which is why alternative means (tanker trucks) are dispatched to assist the affected population, with emphasis on the aforementioned topographically higher areas, where the piped-water supply is scarce and limited to seven (7) hours during the nighttime period (between 23:00 and 06:00 each day), as the appellants partially state in their filing (…) SIXTH: It should be noted and reported to the Honorable Chamber that, in compliance with the requirements applicable to every public official under the principle of legality contained in section 11 of the Constitución Política, as well as sections 11 and 16 of the Ley General de la Administración Pública, and with the express provisions of the Reglamento para la Prestación de los Servicios de AyA, acuerdo de Junta Directiva N° 2020-442, published in Alcance N° 29 of the Diario Oficial La Gaceta N° 27 of martes 9 de febrero del 2021, within the scope of actions falling under the operational authority of the Región Central Oeste and the Unidad Cantonal de Alajuela, the sector supplied by the ‘Tanque Borbón’ is classified as a Deficient Zone (Zona Deficitaria).

Therefore, until the project known as Mejoras al Sistema El Pasito de Alajuela, Etapa II, included in the contrato de Préstamo BCIE 2164, becomes operational, it is impossible to incorporate new urban-development, commercial, or real-estate projects (…) SEVENTH: Specifically, the timeframe for remedying the aforementioned technical inadequacy in the distribution networks of the barrio San José sector corresponds to the project previously identified to the Honorable Chamber, also referenced by the appellants and known as ‘Mejoras al Sistema El Pasito de Alajuela, Etapa II,’ included in the contrato de Préstamo BCIE 2164 and corresponding to project 001563 of the Banco de Proyectos de Inversión Pública (BPIP) of the Ministerio de Planificación y Política Económica (MIDEPLAN), whose progress is detailed in the attached schedule [see Anexo 1], dated diciembre 2021. EIGHTH: That, in view of the technical considerations inherent in operating the pressure zone (zona de presión) controlled by the ‘Tanque Borbón,’ which is in turn connected to the distribution networks extending to the barrio San José sector, the Unidad Cantonal de Alajuela and the Región Central Oeste maintain, throughout the year and with greater frequency during the dry season, the alternative means (tanker trucks) [see Anexo 2] necessary to serve the population of the barrio San José sector, including the appellants, in accordance with the judgment of the Sala Constitucional.

NINTH: Additionally, it should be stated that, since 1 de febrero del 2021, billing adjustments have been applied to affected users in the Dirección04 sector (Dirección05, Buenos Aires, or ‘El Triángulo’) in accordance with article 95 of the Reglamento Técnico ‘Prestación de los Servicios de Acueducto y Alcantarillado Sanitario e Hidrantes, ARPSAYA-2013,’ published in Alcance Digital Nº 50 of La Gaceta Nº 186 of lunes 29 de setiembre del 2014, and its amendment known as ‘Reglamento Técnico Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes, AR-PSAYA-2015’ [See Anexo 3]. This adjustment is also among the actions undertaken by the Región Central Oeste in response to the problem described by the appellants and is applied pursuant to the ground provided for in subsection a. of that section (…)” (emphasis added).

Meanwhile, on 7 de marzo de 2022, the Región Central Oeste of ICAA issued memorandum SG-GSP-RC-2022-00162, which states: “(…) That the Unidad Cantonal de Alajuela and the Región Central Oeste, within the scope of their authority, have established and undertaken ALL possible operational measures, as is clearly demonstrated in report SG-GSP-RC-2022-00091 of 8 de febrero del 2022, which may be summarized as follows: 1. Implementation of an intensive program to identify and eliminate hidden leaks, the results of which are evident, since the so-called ‘Tanque Borbón’ maintains an optimal storage level (see Figure 3 of report SG-GSP-RC-2022-00091). This structure remains at a height of 3 metros, equivalent to a volume of un millón doscientos mil litros of water for human consumption (1 200m³). Nevertheless, this is insufficient to guarantee continuous service to all users in the aforementioned sectors (…) It should be clarified that the preceding graph records minimum values (0,00mca) between 18:00 on viernes 17-feb-2022 and 19:00 on sábado 19-feb-2022, due to the failure of the motor at the so-called Pozo Juan León, which prevented the aforementioned storage level from being maintained during this period. 2.

Deployment and dispatch of alternative means (tanker trucks) to assist the affected population experiencing service interruptions exceeding 8 hours per day, with emphasis on the aforementioned topographically higher areas, where the piped-water supply is scarce and limited to seven (7) hours during the nighttime period (between 23:00 and 06:00 each day, as shown by the green and yellow graph in Figure 3 of report SG-GSP-RC-2022-00091). 3. The Región Central Oeste and the Unidad Cantonal de Alajuela fully adopted the recommendation issued by Ms. Catalina Crespo Sancho, Defensora de los Habitantes, in official letter N° 09249-2020-DHR of miércoles 5 de agosto del 2020, in the document entitled INFORME FINAL CON RECOMENDACIONES, concerning SOLICITUD DE INTERVENCIÓN N° 308575-2020-SI-avh, which I quote: 1. Guarantee tanker trucks carrying water to the community of Dirección04, also known as Dirección08, Dirección05, Barrio San José de Alajuela, whenever it experiences more than eight hours of water-service rationing. 4.

In order to avoid degrading service and increasing the periods of hourly interruption, as well as to prevent impairment of the rights of existing users—particularly those experiencing service interruptions, and even more so under the circumstances affecting current users in barrio San José—the Unidad Cantonal de Alajuela and the Región Central Oeste issue negative decisions on applications for drinking-water service availability (disponibilidad de servicios de agua potable) that could potentially affect the sector in which the appellants reside. This is also unavoidable under the definitions set forth in the Reglamento para la Prestación de los Servicios de AyA, acuerdo de Junta Directiva N° 2020-442, published in Alcance N° 29 of the Diario Oficial La Gaceta N° 27 of martes 9 de febrero del 2021 (…)”.

For its part, on 9 de marzo de 2022, the UEN Programación y Control of ICAA issued report UEN-PC-2022-00494, detailing the background, actions taken, and pending actions required to execute the project “Improvements to the El Pasito de Alajuela Water-Supply System, Phase II.” That memorandum stated: “ Phase 1: • El Erizo-INVU Las Cañas distribution network • Barrio San José distribution network • Lotes Solís distribution network • Replacement of the Puente Arena network • Equipping the Coyol well, disinfection, and electrification of the well site and El Coyol Tank. • El Coyol Tank, 2600 m3 Phase 2: • Juan León well field • Juan León-Borbón Tank transmission line • Pumping main from a new well, yet to be determined, to El Coyol Tank. • Juan León 9m3 break-pressure tank • Equipping the new well. Background Initially, in 2013, the feasibility study (factibilidad) and design of the aforementioned project were developed through external consulting services as part of the investment program known as BCIE 2164, for which the Institution was able to obtain financing for the execution of the works through 2018.

The project’s supply sources depend on drilling wells; for this reason, when the consulting firm initially conducted the feasibility study and design, it located a site known as Monterrocoso, where two wells were drilled in 2014, both to a depth of 150m. Subsequently, in 2016, pumping tests (pruebas de bombeo) were conducted through an external contract, and both wells yielded insufficient flow (caudal) for the development of the project; one well recorded a flow of 3 l/s and the other 10 l/s, whereas approximately 50-60 l/s is required from the two wells combined. In view of the foregoing, another study had to be conducted in El Coyol to locate a different site for drilling wells, and it was completed in 2018. However, because the recommendation of the UEN Gestión Ambiental was that the wells had to be drilled to a depth of 250 m, an external contractor had to be engaged to drill them, since the Institution did not have the necessary equipment.

Thus, a well was drilled in the El Coyol area in 2021, yielding a flow of 33 l/s, and according to the recommendations of Gestión Ambiental, another well cannot be drilled on this property; instead, another location was identified where a well must be drilled. Now, in 2015, the Juan León I well was drilled, yielding a flow of 102 l/s, but this well has a verticality problem; it is currently in operation, and no more than approximately 70 l/s is extracted. With respect to this well field, in 2021 a well was drilled on this same property to replace the existing well and make it possible to extract at least 100 l/s from this well field. Because of the difficulties encountered in obtaining the flow required by the project to meet future demand, in 2019 the decision was made to divide the project into two phases, so that the components that neither required land nor depended on well drilling could be executed as soon as possible.

Accordingly, in agosto 2020 the design for Phase I was delivered to the Región Central Oeste for plan review and approval, and a response was received in febrero 2021. Actions in progress The project has a preliminary design (diseño preliminar), which must be reviewed and updated. It is important to note that Phase 1 has acquired land and approved environmental feasibility (viabilidad ambiental). The design of El Coyol Tank has been completed, while adjustments must be made to the distribution-network design because of changes requested by the Región Central Oeste. With respect to the El Coyol well, the electromechanical-equipment design must be adjusted, and the disinfection system and electrification of the well site and El Coyol Tank must be designed. Now, with respect to Phase 2, the project has approved environmental feasibility, and only one property remains to be acquired (Juan León well protection zone and access).

There is a preliminary design for the Juan León–Borbón Tank transmission line and the Juan León break-pressure tank; only the design of the Juan León well field, the equipment for the new well that must be drilled, and the corresponding pumping main from this well to El Coyol Tank remain pending. Finally, according to the latest change request approved by means of GG-2022-00290, execution of the first phase of the project would be completed in junio of 2025 and the second phase in junio of 2026. Memorandum GG-2022-00290, the processed change request, and the schedule are attached.” Meanwhile, on 10 de marzo de 2022, the Región Central Oeste of ICAA issued memorandum SG-GSP-RC-2022-000181, in which it stated: “(…) It is imperative for this Dirección Regional to report that the Dirección de Operación y Mantenimiento de Sistemas de Agua Potable has established that during the dry season (época de estiaje) (noviembre 2021 - mayo 2022), the hourly service interruption and consequent lack of supply through the El Pasito de Alajuela water-supply system occur daily from 06:00 until 23:00 hours, as stated in point THREE of response report SG-GSP-RC-2022-00091.

This Dirección takes note of the obligation imposed by the Sala Constitucional through resolution N° 2022-004582 at 09:15 on 25 de febrero del 2022; accordingly, this schedule will be communicated to affected users. To that end, during the current month, physical flyers containing this information will be distributed, and the information will also be published through the institutional electronic media designated for this purpose, namely: Web Page Institutional website (www.aya.go.cr), in the section entitled Service Interruptions/Water Shortages, where users may consult bulletins issued by the Institution regarding service disruptions. Additionally, as previously reported and as the Honorable Sala reiterates in its most recent resolution N° 2022-004582 regarding this matter, the Unidad Cantonal de Alajuela continues to distribute water continuously by tanker trucks (alternative means), an activity carried out from 07:00 to 14:00 hours, Monday through Sunday.

This schedule is also extended in force majeure situations (such as the most recent one occurring between 17 and 19 de febrero del 2022) and, as previously indicated, is mandatory pursuant to Judgment N° 2012-014247 at 9:05 hours on 12 de octubre de 2012 (…)” (boldface added).

In light of the foregoing, the Sala deems it necessary to clarify that the problem alleged by the petitioner concerning ICAA’s provision of potable-water service in San José de Alajuela has previously been heard by this specialized jurisdiction. For example, judgment n.° 2012014247 at 9:05 hours on 12 de octubre de 2012 stated:

“IV.- RIGHT OF ACCESS TO POTABLE WATER. In repeated decisions, this Sala has recognized a fundamental right to potable water. This was established in resolution No. 2006-005606, at 15:21 hrs. on 26 de abril del 2006:

(«) VII.-Access to potable water as a human right. In addition to the foregoing, and perhaps the most relevant aspect of this issue, is the nature and function of water for human life. It is unnecessary to explain here the evident and well-known reality that without water there can be neither life nor quality of life and that, therefore, with or without a nationalization law, by its very nature, this matter is not and cannot be a territorial or local matter. The Sala itself has stated in its constitutional case law that access to potable water is a fundamental human right, insofar as it forms part of the substance of the rights to health and life. (SALA CONSTITUCIONAL, judgments numbers 534-96, 2728-91, 3891-93, 1108-96, 2002-06157 2002-10776; 2004-1923). This same line has been maintained in judgments 2003-04654 and 2004-07779, which, insofar as relevant, state:

V.The Sala recognizes, as part of Constitutional Law, a fundamental right to potable water, derived from the fundamental rights to health, life, the environment, food, and adequate housing, among others, as has also been recognized in international human-rights instruments applicable in Costa Rica: thus, it appears explicitly in the Convention on the Elimination of All Forms of Discrimination against Women (art. 14) and the Convention on the Rights of the Child (art. 24); it is also articulated in the International Conference on Population and Development in Cairo (principle 2) and declared in numerous other instruments of International Humanitarian Law. Within our Inter-American Human Rights System, the country is particularly bound in this matter by article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (³Protocol of San Salvador of 1988), which provides: Article 11. Right to a healthy environment 1.-Everyone shall have the right to live in a healthy environment and to have access to basic public services. A lack of resources does not justify the failure of public administrations to fulfill their duties in providing this basic service. (SALA CONSTITUCIONAL, resolutions 2003-04654 and 2004-007779).

For their part, as both the Procuraduría and the representative of AyA rightly acknowledge in their reports, internationally, water is also predominantly recognized as a human right and as a necessary precondition for all our human rights. It is maintained that without equitable access to a minimum amount of potable water, other established rights—such as the right to a standard of living adequate for health and well-being, as well as other civil and political rights—would be unattainable. In noviembre del 2002, the United Nations Committee on Economic, Social and Cultural Rights affirmed that access to adequate quantities of clean water for domestic and personal use is a fundamental human right of every person. Likewise, in General Comment No. 15 concerning compliance with articles 11 and 12 of the International Covenant on Economic, Social and Cultural Rights, the Committee noted that µthe human right to water is indispensable for leading a life in human dignity. It is a prerequisite for the realization of other human rights. It is also emphasized that member States of the International Covenant have a duty to fulfill progressively, without discrimination of any kind, the right to water, which entitles everyone to sufficient, physically accessible, safe, and acceptable water for domestic and personal use.

Several international conferences have also been held, most notably the United Nations Water Conference held in Mar de Plata in 1977, which recognized that all peoples have the right of access to potable water to satisfy their basic needs. The Declaration on the Right to Development, adopted by the UN General Assembly in 1986, also includes a commitment by States to ensure equal opportunity for all to enjoy basic resources.

The concept of meeting basic water needs was further strengthened during the 1992 Earth Summit in Rio de Janeiro. In Agenda 21, governments agreed that, “when developing and using water resources, priority must be given to meeting basic needs and conserving ecosystems.” Similarly, in the Plan of Implementation adopted at the 2002 Johannesburg Summit, governments committed to “employing all policy instruments, including regulation, monitoring... and recovery of the costs of water services,” without allowing cost-recovery objectives to become a barrier to poor people’s access to clean water. There are likewise dozens of international instruments directly and indirectly concerning water as a human right of all persons and peoples, such that, by its very nature, this issue tends not only toward nationalization but also toward the internationalization of its use and exploitation (…) In addition to the foregoing, it must be taken into account that the General Assembly of the United Nations, through resolution No. A/64/L.63/Rev.1 of 26 de julio de 2010, declared (…) the right to drinking water and sanitation to be a human right essential to the full enjoyment of life and all human rights (…).”

V. ON THE VIOLATION OF THE RIGHT OF ACCESS TO DRINKING WATER IN THE SPECIFIC CASE

In this matter, it has been fully and properly established that the community of Dirección09 is experiencing serious problems with the continuity of its drinking-water supply. This follows both from the petitioner’s (recurrente) statements and from the evidence submitted to the case record. This Constitutional Chamber recognizes that the Instituto Costarricense de Acueductos y Alcantarillados is carrying out a project to resolve the problem at issue; nor does this Court overlook the various difficulties encountered in completing the work, which have required the schedules to be revised. Nevertheless, alternative and emergency measures to guarantee the aforementioned community access to this precious resource while the project is completed have been conspicuously absent. In light of the circumstances described, this Constitutional Chamber finds that, without question, the Instituto Costarricense de Acueductos y Alcantarillados was required to adopt provisional measures to guarantee the community access to drinking water, such as using tanker trucks until more extensive measures could be put into operation. Based on these considerations, this Constitutional Chamber must intervene to restore the protected parties (tutelados) to the full enjoyment and exercise of their fundamental rights.

VI. CONCLUSION

In view of the foregoing, the appeal must be granted, with the consequences specified in the operative part (parte dispositiva) of this judgment.

THEREFORE:

The appeal is granted. Johnny Rodríguez Alvarado and Eduardo Lezama Fernández, in their respective capacities as Head of the Alajuela Cantonal Office and General Deputy Manager, both of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever may hold those positions in their stead, are ordered to take immediately all actions within the scope of their authority to implement the pertinent alternative and emergency measures in order to guarantee the community of Dirección03 access to drinking water until the projects devised by the entity are completed (…)” (boldface added).

For its part, in judgment n.° 2020003518 at 9:30 hours on 21 de febrero de 2020, this Chamber stated:

“IV.- Merits. In an amparo proceeding (amparo) brought on similar grounds, this Chamber ruled in judgment n.° 2019008193 at 9:20 hours on 10 de mayo de 2019 as follows:

“ON DRINKING-WATER SERVICE. On repeated occasions, this Court has dismissed appeals such as the one before us because the area for which service is requested lies above the supply elevation (cota de abastecimiento)—that is, the maximum elevation at which service can be provided—or because of other technical impossibilities and objective constraints. Specifically regarding supply problems, after recognizing that the provision of drinking water constitutes an essential fee-based public service, the Chamber’s case law has primarily sought to protect the rights to life and health of natural persons. Thus, guaranteeing the purity of water for human consumption and continuity of its supply are part of the proper and efficient service owed to the customer (see judgment Nº 004253-2014). Additionally, in relation to drinking-water supply problems, this Court has held that, insofar as the respondent authorities (autoridades recurridas) demonstrate that they have acted within their material capabilities to achieve an adequate supply, individuals’ fundamental rights are not violated if the service is provided with some irregularities in flow or supply schedules (see, in this regard, this Chamber’s reasoning in judgments Nº 2008-009714, 2008-018788, 2009-012511, 2010-015448 and 2011-006603, among others).” Later, that same judgment adds the following:

“From the reports submitted by the respondent authorities, which were given under oath with the legal consequences that this entails, it is verified that the Hatillo sector of San José is indeed experiencing a water shortage, which has been aggravated by the considerable demand for drinking water and climatic conditions. From the foregoing, it is clear that the shortage alleged by the petitioner in this matter is not the responsibility of the Instituto Costarricense de Acueductos y Alcantarillados, but rather results from climatic factors and the failure of residents in the lower-lying areas of the sector referred to by the petitioner to use water considerately.”

V.Specific case. In this matter, the petitioner alleges a violation of the fundamental right of access to drinking water of the residents of Barrio San José de Alajuela, in the sector known as el Triángulo. From the report submitted to this Chamber by the respondent authority, which was given under oath with the legal consequences that this entails, it is verified that the sector where the protected parties reside is indeed experiencing a water-supply problem. In this case, the discontinuity in water service is primarily due to the topographic elevation of Buenos Aires, Barrio San José de Alajuela, where the protected parties reside, relative to the Borbón tank, which is the AyA infrastructure serving that community. From the foregoing, it is clear that the shortage alleged by the petitioner in this matter is due to the type of terrain on which the neighborhood is located, at an elevation higher than the supply tank, and is not due to inaction by the Instituto Costarricense de Acueductos y Alcantarillados, as the petitioner claims.

On the contrary, despite the situation described, it is apparent that the respondent authority has made significant efforts to remedy the problem, as was established. The Instituto is currently implementing a project involving improvements to the water system; until those improvements are completed, which is scheduled for the year 2022, and the works—associated with the project Mejoras al Sistema El Patio de Alajuela, Etapa II and incorporated into loan agreement BCIE 2164—become operational, AyA has arranged to assist residents in the locality’s higher-lying areas through alternative measures (tanker trucks), which have been implemented. As to the second issue raised by the petitioner, concerning the alleged failure to respond to complaints filed regarding the lack of water supply, the petitioner provides no evidence of any request submitted by any of the protected parties. In its response, AyA informed this Chamber under oath that the request filed in that regard is dated 01 de febrero de 2020, meaning that it was submitted after this appeal was filed, and that it is being processed by the Dirección Regional de AyA.

In response to that request, the respondent institute immediately called the interested parties to a meeting on miércoles 12 de febrero at 14:00 hours at the Sede Regional Central Oeste, Plantel Cacique, Alajuela, as shown by the email sent at 08:17 hours on lunes 03 de febrero de 2020 to the residents of Dirección03 de Alajuela. The report further shows that, two days before the present appeal was filed, by means of a submission dated 27 de enero de 2020, the user associated with NIS 2001829, identified as Nombre04, who is not a petitioner in this matter, reported a serious discontinuity in water service to AyA. According to the report submitted to this Chamber, the matter was addressed on 28 de enero de 2020 by the Región Central Oeste, which arranged for tanker trucks to be sent daily to that sector, as provided for in the technical regulations. At the same time, service provision was reassessed using the automatic data loggers installed during the period between 28 de enero and 02 de febrero de 2020, the results of which showed service interruptions between 07:00 and 16:00 hours, a period exceeding 8 hours per day without service.

For that reason, the alternative supply through tanker trucks will be maintained. Based on the foregoing, this Chamber rejects the alleged violation and finds that the Instituto Costarricense de Acueductos y Alcantarillados has processed the complaints filed and has been making the necessary efforts to alleviate the water shortage affecting this particular area. Accordingly, there is no indication that it committed any omission causing the situation reported by the petitioner; therefore, the appeal must be dismissed in its entirety, as is hereby ordered” (emphasis added).

Finally, even more recently, the Court ruled on the aforementioned problem by issuing judgment n.° 2022004582 at 9:15 hours on 25 de febrero de 2022, which provided:

“III.- ON DRINKING-WATER SERVICE. On repeated occasions, this Court has dismissed appeals such as the one before us because the area for which service is requested lies above the supply elevation—that is, the maximum elevation at which service can be provided—or because of other technical impossibilities and objective constraints. Specifically regarding supply problems, after recognizing that the provision of drinking water constitutes an essential fee-based public service, the Chamber’s case law has primarily sought to protect the rights to life and health of natural persons. Thus, guaranteeing the purity of water for human consumption and continuity of its supply are part of the proper and efficient service owed to the customer. Additionally, in relation to drinking-water supply problems, this Court has held that, insofar as the respondent authorities demonstrate that they have acted within their material capabilities to achieve an adequate supply, individuals’ fundamental rights are not violated if the service is provided with some irregularities in flow or supply schedules (see, to that effect, Judgment N° 2019-8193 at 9:20 hours on 10 de mayo de 2019).” In this case, first, it is stated under oath that the residents of Dirección10 de Alajuela have not been left without a drinking water supply (abastecimiento de agua potable), but rather experience periods of dynamic pressure variation (variación dinámica de presión) below the minimum pressure threshold required to provide service in sufficient quantity and with continuity.

Furthermore, it is explained that the dynamic condition of the drinking water service in the area at issue in this appeal corresponds to a natural pattern in the operation of drinking water distribution systems: during daytime hours, pressure decreases as a direct consequence of high user demand, especially during the summer season, whereas pressure increases at night due to reduced consumption by the user population. In other words, it is clear that the supply problems in the area where the appellants live are due to technical limitations; therefore, no arbitrary conduct by the Administration is apparent.

Furthermore, with respect to the specific actions undertaken to maintain continuity of service in the community of Dirección04 del barrio San José de Alajuela (also known as the Buenos Aires sector or “El Triángulo” del Barrio San José de Alajuela), it was explained under oath that the following measures are being implemented: A) supplying drinking water by tanker trucks; B) implementation is under way of the Project “Mejoras al Sistema El Pasito de Alajuela, Etapa II,” which was incorporated into BCIE Loan Agreement 2164 and designated as project 001563 in the Banco de Proyectos de Inversión Pública (BPIP) of the Ministerio de Planificación y Política Económica (MIDEPLAN), dating from diciembre 2021, which finances the Programa de Abastecimiento del Área Metropolitana de San José Acueductos Urbanos II y Alcantarillado Sanitario de Juanito Mora de Puntarenas, entered into between BCIE and AyA on 04 de mayo de 2018 and expected to be completed in the fourth quarter of 2022; C) the provisions of artículo 95 of the Reglamento Técnico: Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes, AR-PSAYA-2013 y su Reforma AR-PSAYA-2015 are applied to the residents of the sector, such that they are billed only the fixed drinking water connection charge, and the affected persons are therefore billed for drinking water consumption.

With respect to this issue—that is, the measures taken by the Administration to maintain continuity of service—this Constitutional Court has already found them sufficient to establish that the authorities were acting within their material capabilities to achieve an adequate supply. Thus, in the amparo proceeding (recurso de amparo) processed under expediente N° 20-001681-0007-CO, the appeal was dismissed by Sentencia N° 2020-3518 de las 9:30 horas de 21 de febrero de 2020, based on the reasoning quoted below:

“V.- Specific case. In this matter, the appellant alleges a violation of the fundamental right of access to drinking water of the residents of Barrio San José de Alajuela, in the sector known as el Triángulo. The report submitted to this Chamber by the respondent authority, which was given under oath with the legal consequences that this entails, confirms that there is indeed a water-supply problem in the sector where the protected persons reside. In this case, the discontinuity in water service is primarily due to the topographic elevation of Buenos Aires, Barrio San José de Alajuela, where the protected persons reside, relative to the Borbón tank, which is the AyA infrastructure serving that community. From the foregoing, it is clear that the shortage alleged by the appellant in this matter is attributable to the terrain on which the neighborhood is situated, at a higher elevation than the supply tank, and is not due to inaction by the Instituto Costarricense de Acueductos y Alcantarillados, as the appellant claims.

On the contrary, despite the situation described, it is apparent that the respondent authority has made significant efforts to remedy the problem, as established. The Instituto is currently implementing a project involving improvements to the water system; and until those improvements are completed, which is expected in 2022, and the works associated with the project Mejoras al Sistema El Patio de Alajuela, Etapa II, incorporated into BCIE Loan Agreement 2164, become operational, AyA has arranged to assist residents in the higher areas of the locality through alternative measures (tanker trucks), which have been implemented.

(…) Based on the foregoing, this Chamber finds no violation as alleged and considers that the Instituto Costarricense de Acueductos y Alcantarillados has addressed the complaints filed and has been making the necessary efforts to alleviate the water shortage affecting this particular area. Accordingly, there is no indication that it has committed any omission causing the situation reported by the appellant; therefore, the appeal must be dismissed in all respects, as is hereby ordered.” In view of the foregoing considerations, this Court finds that the respondent authority has not violated the appellants’ right of access to drinking water and, accordingly, the appeal must be dismissed, as is hereby ordered. Nevertheless, the respondent authority must take note of its obligation to communicate the water-outage schedules and to supply users with drinking water by tanker trucks until the works intended to provide a permanent solution to the situation have been fully completed” (emphasis added).

Thus, contrary to the appellant’s allegations, in the sub examine it has not been established that the Instituto Costarricense de Acueductos y Alcantarillados carries out arbitrary and unlawful interruptions of the water supply in San José de Alajuela. Rather, as this Court stated in the aforementioned sentencia n.° 2012014247 de las 9:05 horas del 12 de octubre de 2012, that locality has problems with continuity of the drinking water supply. This situation derives from “the topographic elevation of Buenos Aires, Dirección09, where the protected persons reside, relative to the Borbón tank, which is the AyA infrastructure serving that community. From the foregoing, it is clear that the shortage alleged by the appellant in this matter is attributable to the terrain on which the neighborhood is situated, at a higher elevation than the supply tank, and is not due to inaction by the Instituto Costarricense de Acueductos y Alcantarillados” (see sentencia n.° 2020003518 de las 9:30 horas del 21 de febrero de 2020).

In addition, it should be noted that this area experiences periods of dynamic variation, meaning that “during daytime hours pressure decreases in direct relation to demand and consumption, whereas it increases during nighttime hours due to reduced consumption by the user population” (in this regard, see memorando SG-GSP-RC-2022-00091 del 8 de febrero de 2022). Ergo, in the sub iudice it has not been established that the alleged problem concerning continuity of the drinking water supply in San José de Alajuela is attributable to arbitrary action by ICAA in the manner alleged.

Having clarified the foregoing, as stated in rulings n. os 2020003518 de las 9:30 horas del 21 de febrero de 2020 and Telf04 de las 9:15 horas del 25 de febrero de 2022, although the existence of the aforementioned supply problem has been established in this case, it is equally true that the record shows that ICAA has adopted various measures to provide both a permanent and a temporary solution to the situation. For example, the project “Mejoras al sistema de acueducto de El Patio de Alajuela, Etapa II” is being carried out, and residents of San José de Alajuela are also being assisted through tanker trucks in an effort to maintain continuity in the provision of water service.

Accordingly, the appeal cannot be granted on the terms in which it was filed. Nevertheless, the respondent authorities are hereby advised that they must coordinate as necessary and undertake all actions within the scope of their powers to guarantee the supply of drinking water to users in San José de Alajuela through tanker trucks until the works intended to provide a permanent solution to the problem alleged in the sub lite have been fully completed” (emphasis added).

The precedents transcribed above are applicable to the sub iudice because there are no grounds for departing from the criterion expressed therein or for assessing the situation presented differently. Accordingly, this Court has stated in several judgments that barrio San José de Alajuela has a problem with continuity in the provision of drinking water service, which is attributable to the topographic elevation of the locality relative to the location of the tank responsible for supplying water to that area. Likewise, this Chamber has found it established that the indicated location experiences periods of dynamic variation related to the level of water consumption during nighttime and daytime hours, resulting in changes in the capacity to provide that water. Additionally, this Chamber has established that, in response to the problem described, the Instituto Costarricense de Acueductos y Alcantarillados has carried out a series of actions to remedy the shortage. These actions include the project “Mejoras al sistema de acueducto de El Patio de Alajuela, Etapa II,” as well as sending tanker trucks to the affected communities in an effort to maintain continuity in the provision of the service.

Furthermore, regarding the problem alleged by the appellant that occurred in early junio de 2022, this Court confirms that, between 4 and 8 of that month, the CO-A-01 El Pasito system experienced a technical-operational imbalance that caused discontinuity in the provision of drinking water service in the areas supplied by the Cacique and Borbón tanks, “which was caused by a sudden, unscheduled failure in the pumping equipment of the so-called Dirección11, a water source that accounts for 24% of the drinking water produced for human consumption by the Sistema CO-A-01 El Pasito de Alajuela.” Consequently, ICAA dispatched its own and rented tanker trucks to the affected areas to guarantee the minimum subsistence supply.

Accordingly, it has not been established in this case that the problem concerning continuity of the drinking water supply in San José de Alajuela is attributable to arbitrary conduct by ICAA, but rather to the particular conditions in that area regarding its topographic elevation and the population’s consumption. Moreover, the discontinuity in the provision of that service between 4 and 8 de junio de 2022 was due to a failure in the pumping equipment and, while the problem was being resolved, ICAA sent tanker trucks to the affected areas to guarantee the minimum subsistence supply.

Therefore, the petition may not be granted on the terms in which it was filed. Additionally, the petitioner is advised that it is not for this Constitutional Court to assess, under the subconstitutional regulations governing the matter and the particular circumstances of the case under review, whether the measures adopted by the ICAA to address the problem alleged in the case at hand (sub lite) are appropriate, or to determine the specific actions that the institute must take to resolve the discontinuity of the drinking-water supply in San José de Alajuela.

Accordingly, the petition for constitutional relief (amparo) is denied. Nevertheless, the respondent authorities are hereby advised that they must undertake the necessary coordination and carry out all actions falling within the scope of their authority in order to guarantee the supply of drinking water to users in San José de Alajuela by means of tanker trucks until the works intended to provide a permanent solution to the problem alleged in the matter under review (sub examine) have been definitively completed.

IV.Finally, the petitioner is advised that it is not for this specialized court to rule, under the subconstitutional regulations governing the matter and the particular circumstances of the case under review, on the objections raised by the petitioner concerning the contract entered into between the ICAA and the company that owns the tanker trucks used in the area where she resides. Accordingly, if the protected party so wishes, she may raise those objections before the respondent authority itself or through ordinary judicial proceedings.”

Consistent with the precedents transcribed above, in the case at hand the petitioner expresses disagreement with the actions of the Instituto Costarricense de Acueductos y Alcantarillados concerning the water shortage in San José de Alajuela. Specifically, he claims: 1) that no effective solution has been found for the problem; 2) that the tanker trucks and the officials distributing the water do not comply with hygiene standards; and 3) that the respondent institute expects residents to install a water intake to fill their tanks, even though they lack the financial means to do so.

Regarding the first issue, this Chamber finds that, although the ICAA authorities have not guaranteed a permanent solution to the water-supply shortage in San José de Alajuela, this is not due to arbitrary decisions by the institute. This is as this Chamber found in the cited precedents, which established that the locality has problems with the continuity of its drinking-water supply arising from “the topographic elevation of the location Buenos Aires, Dirección09, where the protected parties reside, relative to the Borbón tank, which is the AyA infrastructure serving that community. From the foregoing, it is clear that the shortage alleged by the petitioner in this matter is due to the type of terrain on which the neighborhood is located, which is at a high elevation above the supply tank, and is not due to inaction by the Instituto Costarricense de Acueductos y Alcantarillados” (see, to the same effect, judgment no. 2020003518 at 9:30 hours on 21 de febrero de 2020).

It is also established that the ICAA has adopted a series of measures to provide solutions to the situation described. For example, the project “Improvements to the Pasito de Alajuela water-supply system (Mejoras al sistema de acueducto de Pasito de Alajuela)” is currently being implemented, and drinking water is being supplied provisionally by tanker trucks.

Regarding the second issue, namely hygiene in the supply of water by tanker trucks, the respondent authorities deny the allegations and state that “the water transported in the tanker trucks is one hundred percent potable, in accordance with the quality standard required of the tanker-truck companies contracted by AyA.” They also attach the water-quality reports issued by the Laboratorio Nacional de Aguas.

In this regard, it must be noted that it is beyond this Chamber’s capacity, through the summary amparo proceeding, to determine whether the hygiene measures followed in the water-supply operations are optimal. Likewise, this Chamber must not act as a forum for processing complaints; accordingly, the complaint concerning the operators’ clothing, the cleanliness of the truck, the manner in which the hose is handled, and the officials’ alleged smoking must be raised—if the petitioner so wishes—before the respondent authority itself or through ordinary judicial proceedings.

Finally, regarding the complaint concerning the obligation to build a water intake to fill the tank at each home, the report submitted under oath indicates that this notice had been revoked before this amparo was filed, following the meeting held on 31 de enero de 2023 between representatives of Dirección09, the general manager, and officials from the technical division of the ICAA’s Región Central Oeste.

Therefore, on the terms in which the amparo was filed, no acts or omissions of constitutional significance by the respondent authorities have been established.

Consequently, the petition for constitutional relief must be dismissed, but not without first advising the ICAA authorities that they must continue carrying out all actions falling within the scope of their authority in order to guarantee the supply of drinking water to users in San José de Alajuela by means of tanker trucks, in full compliance with hygiene standards, until the works intended to provide a permanent solution to the water-supply shortage in the affected area have been completed.”

IV.ON THE MERITS.- The precedent transcribed above applies to the case at hand because there are no grounds for departing from the position stated therein or reasons for assessing the situation presented differently. This is because it has been established that the problem concerning the continuity of the drinking-water supply in San José de Alajuela is attributable to particular conditions involving the area’s topographic elevation and the population’s consumption. It is also established that the ICAA is implementing the “Proyecto de Mejoras del Acueducto El Pasito,” under the responsibility of the Unidad Ejecutora de Acueductos y Alcantarillados and financed by the Banco Centroamericano de Integración Económica, to provide a permanent solution to the water-supply problem. It is further established that, while the project is being developed, the aforementioned community is supplied with water daily by tanker trucks. Likewise, according to the report submitted under oath, NIS service [Valor 002], billed under Nombre01 of the petitioner [Nombre01 001], has received drinking-water service through the pipeline because this water meter (hidrómetro) recorded consumption during enero, febrero, marzo and abril 2024.

In that regard, it should be noted that the petitioner does not allege a lack of water supply per se, but rather expresses dissatisfaction with the progress of the project works and the manner in which the water is distributed, without specifying the nature of the alleged unequal treatment; moreover, it has been demonstrated in these proceedings that the claimant receives the service at her home. Based on the foregoing, the petition must be denied.

V. DISSENTING OPINION OF JUSTICE RUEDA LEAL

In the matter under review, the petitioner alleges a drinking-water shortage in the community of Dirección01 de San José de Alajuela. He asserts that this situation has existed since 2012 and has not yet been resolved.

In this regard, I consider that, as has occurred in other matters alleging supply problems of this magnitude (for example, expediente nro. 20-004883-0007-CO), it is essential to join the Autoridad Reguladora de Servicios Públicos as a party. Indeed, in the judgment issued in the aforementioned proceedings (no. 2020007754 at 9:45 hours on 24 de abril de 2020), the Chamber noted that, in submitting its report, ARESEP identified a series of problems at the ICAA concerning infrastructure investment, losses from unaccounted-for water, and implementation capacity. On that occasion, this Court held: “In this regard, the record not only shows that the water-supply shortage had been apparent since 2017, but also that ARESEP indicated that the ICAA had fallen behind in infrastructure investment and, moreover, had incurred significant losses from unaccounted-for water. Likewise, the regulatory entity also stated that the capacity of drinking-water service operators to implement projects had not been as desired.” Accordingly, I dissent and order that the petition continue to be processed so that a report may be requested from the general regulator of the Autoridad Reguladora de los Servicios Públicos.

VI.DOCUMENTATION SUBMITTED TO THE CASE FILE.- This Chamber must advise the petitioner that, if she submitted any paper documents, as well as objects or evidence stored on any additional device or on electronic, computer, magnetic, optical, telematic, or new-technology media, they must be retrieved from the court office within 30 business days after notification of this judgment is received; otherwise, all such materials will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo del 2012, Article LXXXI.

Por tanto:

The petition is denied. Justice Rueda Leal dissents and orders that the petition continue to be processed so that a report may be requested from the general regulator of the Autoridad Reguladora de los Servicios Públicos.

Considerando:

I. OBJETO DEL RECURSO

• Tanque El Coyol 2600 m3 Fase 2: • Campo pozos Juan León • Línea conducción Juan León-Tanque Borbón • Línea impulsión pozo nuevo por definir a Tanque El Coyol.
