Document Review Decision No. 2024010062 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on diecinueve de abril de dos mil veinticuatro.

Amparo proceeding (recurso de amparo) processed under case number 23-030389-0007-CO, filed by [Nombre01 001], of legal age, identity card [CED01], against the Secretaría Técnica Nacional Ambiental and the Dirección Regional del Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación, both under the Ministerio de Ambiente y Energía.

Findings of Fact:

  1. 1By a filing received by the Chamber’s Secretariat at 11:08 on 07 de diciembre de 2023, the appellant filed an amparo proceeding against the Secretaría Técnica Nacional Ambiental—SETENA—of the Ministerio de Ambiente y Energía—MINAE—and stated that, since 18 de agosto de 2023, she had filed an environmental complaint (denuncia ambiental) with the respondent authority, which is being processed under case No. D1-0092-2022-SETENA, PROYECTO RESIDENCIAS LATI. She explains that the complaint concerned the unauthorized clearing of a forest in Cóbano for the purpose of constructing several residences. She alleges that, for this purpose, a land-use change (cambio de uso del suelo) was carried out on a hill that was forested land, resulting in the loss of biodiversity in a biological corridor and adverse effects on the climate and landscape. She argues that “for that land-use change, the respondents did not even establish in the environmental permit (licencia ambiental) the requirement for a declaration of national interest (declaratoria de conveniencia nacional), if one were applicable, as required by the environmental regulations in the Ley Forestal, which is linked by connection to Article 50 of the Constitution.” She states that, on 18 de agosto, a report from the Sistema Nacional de Áreas de Conservación was submitted describing the forest characteristics of the affected site and the evident and manifest change thereto, but none of this was taken into account.She alleges that “as shown in our complaint, a measure was requested requiring the suspension of the project, but nothing has been done. 6- The respondents merely notified us on 28 de agosto, through official letter Nombre02 DT ASA L699-2023, that the matter was being referred to the construction company; however, more than two months have elapsed since then and, to date, nothing has been decided, even though we requested precautionary measures (medidas cautelares). 7- To date, we are still waiting for the environmental permit to be revoked and for environmental restoration and protection measures to be adopted on the hill where construction is taking place and where the forest was removed.” Based on the allegations set forth, she considers that the challenged conduct violated fundamental rights. She requests that the proceeding be granted.
  2. 2By decision issued at 10:05 on 11 de diciembre de 2023, the Presidency of the Chamber admitted this proceeding for consideration and requested that the Secretary General of Nombre02 submit a report regarding the facts alleged by the appellant.
  3. 3Ulises Álvarez Acosta, in his capacity as Secretary General of Nombre02, reports under oath (filing submitted at 13:20 on 19 de diciembre de 2023) that a report was requested from the Departamento de Auditoría y Seguimiento Ambiental, which was issued through official letter SETENA-DT-ASA-2361-2023 by the department responsible for processing the complaint. The report details the follow-up undertaken and is transcribed below:

“FIRST: On 30 de marzo del 2022, through decision No. 551-2022-Nombre02, environmental viability (Viabilidad Ambiental) was granted for case D1-0092-2022-SETENA, Residencias Lati project, with the following characteristics:

“3 one- and two-story residential houses totaling 1695 m2, with access roads, a swimming pool, green areas, and parking. Materials such as concrete, wood, glass, metal framing, ceramics, among others, will be used. During the construction stage, the project site will first be cleared and graded, followed by construction. During the operational stage, the residences will be occupied and operated. The coverage corresponds to 33,60% of the total area shown on the plan, and the remaining 66,40% will be maintained as a green area. Earthworks (movimientos de tierra) are contemplated, with volumes of up to 10.000 m3 to be hauled outside the project area (AP). The earthworks will involve 2055,74 m3 of excavation and 455,08 m3 of fill; these activities will be performed properly, and material removed from the direct project area (AOP) will be handled by an authorized manager, who will dispose of the material appropriately.

Health and hygiene measures will also be implemented for the equipment used to remove material from the AOP. A system of proven effectiveness, such as a FAFA system or improved tanks, shall be used. The required setbacks between drainage systems and structures and property boundaries shall be observed. The area where the septic tank will be located shall not be made impermeable.” SECOND: On 20 de abril del 2023, filing number 04083-2023 was received concerning an environmental complaint submitted by Ms. [Nombre01 001] against the referenced project.

THIRD: On 26 de abril de 2023, through official letter SETENA-DT-ASA-0791-2023, the project developer was asked to respond to the complaint filed, within 10 business days. The foregoing was done in observance of due process (debido proceso).

FOURTH: On 12 de mayo de 2023, the Departamento de Auditoría y Seguimiento Ambiental conducted a field inspection of the project area, as recorded in inspection report ASA-ACT-INS-0053-2022, to follow up on the complaint.

FIFTH: On 05 de abril del 2023, 29 de abril del 2023, and 09 de mayo del 2023, under digital platform case numbers 17713, 17647, and 18135, Mr. Daniel Loría Sims, environmental manager (regente ambiental), submitted technical responses to the complaint filed against the project, pursuant to official letter SETENA-DT-ASA-0791-2023, through which the complaint was referred to the project developer.

SIXTH: On 1 de junio de 2023, through decision No. 0830-2023-Nombre02, the complaint filed with Nombre02 on 20 de abril del 2023 by complainant [Nombre01 001] against the Residencias Lati project was partially upheld.

The allegation concerning material being washed onto the public roadway was the only part of the complaint that was partially upheld. This was because the inspection indicated that, during the March rainfall, the environmental measures intended to mitigate the runoff of soil remaining on the site as a result of the earthworks performed for the construction of the two residential houses, which are currently at the structural shell stage, had not yet been installed. Although the earthworks had been completed and the excavated soil had even been transported to a neighboring property, the fact remains that, during the rainfall, residual material from the project area reached the public roadway. However, this project was not the only source of the reported material, because another project involving substantial earthworks borders the property covered by the referenced case; for that reason, the complaint was partially upheld. The complaint was denied in all other respects. The developer was also ordered to maintain the mitigation and control measures intended to prevent sediment runoff.

SEVENTH: On 08 de junio del 2023, filing number 05732-2023 was received concerning a motion for reconsideration (recurso de revocatoria) of decision 0830-2023-SETENA, filed by Mr. Álvaro Sagot Rodríguez, attorney-in-fact for Ms. [Nombre01 001].

EIGHTH: On 18 de agosto del 2023, filings 08202 and 08203-2023 were received concerning the submission of new evidence relating to the environmental complaint regarding irregular conditions at the project, filed by Mr. Álvaro Sagot Rodríguez, attorney-in-fact for [Nombre01 001].

NINTH: On 28 de agosto de 2023, through official letter SETENA-DT-ASA-1699-2023, the project developer was again asked to respond, within 10 business days, to the expanded complaint filed on 18 de agosto del 2023, in observance of due process.

TENTH: On 30 de agosto de 2023, through decision No. 1257-2023-Nombre02, the motion for reconsideration of decision 0830-2023-Nombre02 of 1 de junio del 2023 was denied, and that decision remained unchanged.

ELEVENTH: On 13 de setiembre del 2023, filing number 09099-2023 was received containing the response and evidence in defense (pruebas de descargo) requested through official letter SETENA-DT-ASA-1699-2023, by which the developer was afforded a hearing to address the expanded complaint.

TWELFTH: On 19 de setiembre de 2023, after reviewing the response submitted by the developer, the Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación was asked, through official letter SETENA-DT-ASA-1883-2023, to provide a technical opinion (criterio técnico) so that the complaint could be addressed, as evidence to assist in reaching a decision (prueba para mejor resolver).

THIRTEENTH: On 9 de noviembre del 2023, through official letter SETENA-DT-ASA-2140-2023, the Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación was reminded of the request for a technical opinion, so that the complaint filed could be decided.

FOURTEENTH: On 18 de diciembre del 2023, a response was received from SINAC through official letter SINAC-ACT-OR-DR-1991-2023, forwarding report ACT-OSRC-274-2023 in response to the inquiry submitted through official letters 1883-2023 and SETENA-DT-ASA-2140-2023.” Conclusion. Based on the background set forth in this official letter, it is shown that Nombre02 has performed the necessary actions in a timely and proper manner to duly follow up on the complaint filed by Ms. [Nombre01 001], represented by Mr. Álvaro Sagot Rodríguez, and that, as of the date notice of this amparo proceeding was served, the matter had not been decided because a response from the Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación was still pending. At this stage, official letter SETENA-DT-ASA-1883-2023, dated 19 de setiembre de 2023 and served on 02 de octubre de 2023, was sent, followed by reminder letter SETENA-DT-ASA-2140-2023, dated 09 de noviembre de 2023 and served on 10 de noviembre de 2023.

Furthermore, on lunes 18 de diciembre de 2023, that Secretariat received the response from SINAC through official letter SINAC-ACT-OR-DR-1991-2023, forwarding report ACT-OSRC-274-2023 in response to the inquiry submitted through official letters SETENA-DT-ASA-1883-2023 and SETENA-DT-ASA-2140-2023. Accordingly, the information provided by SINAC will be analyzed in order to decide and respond to the complaint filed by Ms. [Nombre01 001]. The response received from the Área de Conservación Tempisque on lunes 18 de diciembre del 2023 is essential for addressing the allegations set forth in the complaint, particularly those described below: 1. Whether the work performed by the developer under plan P-2248092-2020, property number 244707-000, is the work for which earthworks, terrace formation, and the opening of roads in a forest area were reported, in accordance with the forest ecosystem determination ACT-OSRC-197-2023. 2.

Whether, based on the field inspections and survey performed, it can be determined that the observed changes in forest cover (cobertura forestal) correspond to the buildings and roads of the project under plan P-2248092-2020, property number 244707-000. He requests that the proceeding be denied.

  1. 4By decision issued at 16:55 on 26 de febrero de 2024, the Justice-Rapporteur expanded the proceeding to include the Director of the Oficina Regional del Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación.
  2. 5By decision issued at 17:17 hours on 26 February 2024, as evidence to assist adjudication (prueba para mejor resolver), the Reporting Justice requested Ulises Álvarez Acosta, in his capacity as Secretary General of Nombre02, or whoever holds that position, to report the following to this Chamber: 1) The date on which the environmental complaint filed by the appellant was decided. 2) The date on which the appellant was notified of the decision.
  3. 6Nelson Marín Mora, in his capacity as Regional Director of the Tempisque Conservation Area of the National System of Conservation Areas of the Ministry of Environment and Energy, reports under oath (brief filed at 10:26 hours on 05 March 2024) as follows:

“FIRST: Oficio SETENA-DT-ASA-1883-2023 was received on 02 October 2023. Through oficio SETENA-DT-ASA-1883-2023, Nombre02 states and requests the following:

“Report ACT-OSRC-201-2023 dated 04 August 2023 indicates, in Table 1, the survey-plan numbers and owners of the properties under investigation. On page 7 of this report, it states ‘that this is a very large and complex case, given that it involves a parent property that was recently partitioned into several properties, and it is therefore necessary to overlay the survey plans for each of the properties in order to determine on which properties each of the documented events occurred.’ As part of the information cited in the preceding paragraph, because it is stated that the technical report applies to the 9 survey plans in Table 1, without specifically determining what pertains to the property on which expediente D1-0092-2022-SETENA, Residencias Lati, is being developed, we require—and, based on the principle of inter-institutional coordination (principio de coordinación interinstitucional), request—that SINAC inform this Secretariat of the following:

1. Whether the work performed by the developer under survey plan P-2248092-2020, property number 244707-000, is the work described as involving earthworks (movimientos de tierra), construction of terraces, and opening of roads within a forest area, in accordance with the determination of the forest ecosystem in ACT-OSRC-197-2023.

2. Whether, based on the field inspections and the survey conducted, it can be determined that the observed changes in forest cover (cobertura forestal) correspond to the buildings and roads of the project under survey plan P-2248092-2020, property number 244707-000.

Technical report ACT-OSRPL-197-2023 dated 27 July 2022, Determination of Forest in Accordance with the Definition in Ley Forestal 7575 of Costa Rica, states on page 3, in the introduction section, that the study covers properties 6-244715-000, 6-244720-000, 6- 244718-000, 6-244709-000 and 6-2447708-000, excluding the property on which expediente D1-0092-2022-SETENA, Residencias Lati, is being developed, survey plan P-2248092-2020, property number 244707-000. For this reason, we require you to indicate whether or not there is forest on this property and whether it has been logged.”.

SECOND: On 26 September 2023, as part of the follow-up to judicial case 23-000028- 0611-PE, in which the developer under survey plan P-2248092- 2020, property number 244707-000, appears as a possible accused, an expert assessment (pericia) was conducted to delimit the works and the impact on the forest on each of the properties investigated in that case.

THIRD: Between 26 September 2023 and 23 November, the analysis of the information collected was completed, and oficio ACT-OSRPL-641-2023 was issued to Licda. Silvia Solís Dávila, Environmental Prosecutor, Deputy Agrarian-Environmental Prosecutor’s Office. It should be noted that, due to institutional needs arising from a lack of personnel, the official in charge of the investigation also assumed, among other responsibilities, two additional supervisory assignments at the Paquera-Lepanto and Cóbano subregional offices, which affected response times because of the high volume of additional work.

FOURTH: On 05 December 2023, oficio ACT-OSRC-274-2023 was issued in response to Oficio SETENA-DT-ASA-1883-2023, stating the following:

  • 1)The work performed by the developer under survey plan P-2248092-2020, property number 244707-000, forms part of the complaint concerning land-use change (cambio de uso del suelo) corresponding to case 23-000028-0611-PE.
  • 2)Technical report ACT-OSRPL-197-2023 excludes the property on which expediente D1-0092-2022-SETENA, Residencias Lati, is being developed, survey plan P-2248092-2020, property number Dirección01, considering that, when the forest expert assessment was prepared, the pre-existing cover at the indicated site had been altered and partially removed; therefore, it was not feasible to use that area as a control site for the study.
  • 3)The Code of Criminal Procedure provides in Article 295, Confidentiality of Proceedings: ‘The preparatory proceeding shall not be public as to third parties. The proceedings may be examined only by the parties, either directly or through their representatives. Attorneys asserting a legitimate interest shall be informed by the Public Prosecution Service of the matter under investigation and of any accused or detained persons, so that they may decide whether to participate in the case. The parties, the officials participating in the investigation, and all other persons who, for any reason, become aware of the proceedings conducted shall be obligated to maintain confidentiality. Failure to comply with this obligation shall be considered serious misconduct.’ Because this case is under investigation and action is being taken under the functional direction of the Cóbano Prosecutor’s Office, this official is acting in accordance with Article 295 of the Code of Criminal Procedure.

Por tanto, you are hereby informed that the reported events form part of an open judicial case, which has been handled by the Cóbano subregional office and may not be disclosed.”

  1. 7Ulises Álvarez Acosta, in his capacity as Secretary General of Nombre02, reports under oath (brief filed at 13:47 hours on 21 March 2024) that the complaint filed by the appellant was decided through decision No. 0186-2024-Nombre02 issued at 10:45 hours on 07 February 2024. According to the proof of notification, the appellant was notified thereof on 7 February 2024, at 11:36 hours, at the email address ...01, the address indicated in the complaint. He requests that the action be dismissed.
  2. 8The statutory requirements have been observed in the proceedings conducted.

Justice Castillo Víquez drafts the opinion; and,

Considerando:

I.Jurisdiction over this case due to infringement of Article 41 of the Political Constitution. Before analyzing the merits of the matter, it must be clarified that, since judgment No. 2008-002545 issued at 08:55 hours on 22 February 2008, this Chamber has referred to the contentious-administrative jurisdiction—with certain exceptions—those matters in which the issue is whether the Public Administration complied with the time limits established by the General Law of Public Administration (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, for issuing a final administrative act resolving an administrative proceeding—initiated ex officio or at the request of a party—or for hearing the applicable administrative appeals. Specifically, the sub lite presents an exceptional circumstance because it concerns an environmental complaint that allegedly was not resolved within a reasonable period. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this amparo action (recurso de amparo).

II.Subject matter of the action. The appellant alleges that, on 18 August 2023, she filed an environmental complaint with SETENA, which is being processed in expediente No. D1-0092-2022-SETENA, PROYECTO RESIDENCIAS LATI. She explains that the complaint concerns the unauthorized logging of a forest in Cóbano for the purpose of building several residences. She states that a measure was requested to suspend the project, but nothing has been done. They were notified only on 28 August, through oficio Nombre02 DT ASA L699-2023, that the matter had been forwarded to the construction company, but more than two months have elapsed since then without a decision, even though interim measures (medidas cautelares) were requested. She continues to await the revocation of the environmental license, as well as the adoption of environmental restoration and protection measures for the hill where construction is taking place and the forest was removed.

III.Proven facts. The following facts are deemed duly established and relevant to the determination of this matter, either because they have been substantiated or because the respondents failed to address them as ordered in the initial decision:

  • 1)On 30 March 2022, through decision No. 551-2022-SETENA, Nombre02 granted environmental viability (Viabilidad Ambiental) to expediente D1-0092-2022-SETENA, project Residencias Lati (see the first report of the Secretary General of SETENA).
  • 2)On 20 April 2023, filing number 04083-2023 was received concerning an environmental complaint by Ms. [Nombre01 001] against the referenced project (see the first report of the Secretary General of SETENA).
  • 3)On 26 April 2023, through oficio SETENA-DT-ASA-0791-2023, the project developer was requested to respond to the complaint filed within 10 business days (see the first report of the Secretary General of SETENA).
  • 4)On 12 May 2023, the Environmental Audit and Monitoring Department conducted a field visit to the project area, as recorded in inspection report ASA-ACT-INS-0053-2022, as part of the follow-up to the complaint (see the first report of the Secretary General of SETENA).
  • 5)On 05 April 2023, 29 April 2023 and 09 May 2023, under digital-platform case numbers 17713, 17647, 18135, Mr. Daniel Loría Sims, environmental manager (regente ambiental), submitted technical responses to the complaint filed against the project, pursuant to oficio SETENA-DT-ASA-0791-2023, through which the matter was forwarded to the project developer (see the first report of the Secretary General of SETENA).
  • 6)On 1° June 2023, through decision No. 0830-2023-SETENA, the complaint filed with Nombre02 on 20 April 2023 by complainant [Nombre01 001] against the Residencias Lati project was partially upheld. Only the allegation concerning materials being washed onto the public roadway was upheld in part. The complaint was denied in all other respects. In addition, the developer was ordered to maintain the mitigation and control measures for sediment runoff (see the first report of the Secretary General of SETENA).
  • 7)On 08 June 2023, filing number 05732-2023 was received concerning the motion for reconsideration (recurso de revocatoria) against decision 0830-2023-SETENA, filed by Mr. Álvaro Sagot Rodríguez, attorney-in-fact for Ms. [Nombre01 001] (see the first report of the Secretary General of SETENA).
  • 8)On 18 August 2023, filing numbers 08202 and 08203-2023 were received concerning the submission of new evidence relating to the environmental complaint regarding irregularities in the project, filed by Mr. Álvaro Sagot Rodríguez, attorney-in-fact for [Nombre01 001] (see the first report of the Secretary General of SETENA).
  • 9)On 28 August 2023, through oficio SETENA-DT-ASA-1699-2023, the project developer was again requested to respond, within 10 business days, to the expansion of the complaint filed on 18 August 2023, in observance of due process (debido proceso) (see the first report of the Secretary General of SETENA).
  • 10)On 30 August 2023, through decision No. 1257-2023-SETENA, the motion for reconsideration filed against decision 0830-2023- Nombre02 of 1° June 2023 was denied, and that decision remained unchanged (see the first report of the Secretary General of SETENA).
  • 11)On 13 de setiembre de 2023, consecutive filing 09099-2023 was received concerning the response containing the exculpatory evidence (pruebas de descargo) requested through official letter SETENA-DT-ASA-1699-2023, whereby the developer was granted a hearing to address the expansion of the complaint (see the first report of the Secretary General of SETENA).
  • 12)On 19 de setiembre de 2023, after analyzing the response provided by the developer, through official letter SETENA-DT-ASA-1883-2023, the Área de Conservación Tempisque, Sistema Nacional de Áreas de Conservación, was asked to provide a technical opinion as evidence to assist in reaching a decision (prueba para mejor resolver), so that the complaint could be addressed (see the first report of the Secretary General of SETENA).
  • 13)On 02 de octubre de 2023, the Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación received official letter SETENA-DT-ASA-1883-2023, in which Nombre02 requests a technical opinion (see the report of the Regional Director of the Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación).
  • 14)On 26 de setiembre de 2023, as part of the follow-up to court case 23-000028-0611-PE, in which the developer appears as a possible defendant in connection with survey plan P-2248092-2020, property number 244707-000, the Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación conducted an expert assessment (pericia) of the boundaries of the works and the impact on the forest on each of the properties investigated in that case (see the report of the Regional Director of the Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación).
  • 15)Between 26 de setiembre de 2023 and 23 de noviembre de 2023, the Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación completed its analysis of the information gathered, and official letter ACT-OSRPL-641-2023 was issued to Licda. Silvia Solís Dávila, Environmental Prosecutor, Fiscalía Adjunta Agrario Ambiental. It should be noted that, due to institutional needs arising from a lack of personnel, the official in charge of the investigation also assumed, among other duties, two additional supervisory assignments at the Paquera-Lepanto and Cóbano subregional offices, which affected response times because of the heavy additional workload (see the report of the Regional Director of the Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación).
  • 16)On 09 de noviembre de 2023, through official letter SETENA-DT-ASA-2140-2023, Nombre02 sent the Área de Conservación Tempisque, Sistema Nacional de Áreas de Conservación, a reminder of the request for a technical opinion, so that the complaint filed could be resolved (see the first report of the Secretary General of SETENA).
  • 17)On 05 de diciembre de 2023, official letter ACT-OSRC-274-2023 was issued, whereby the Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación responded to official letter SETENA-DT-ASA-1883-2023 (see the report of the Regional Director of the Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación).
  • 18)On 18 de diciembre de 2023, the response from SINAC was received under official letter SINAC-ACT-OR-DR-1991-2023, forwarding report ACT-OSRC-274-2023 in response to the inquiry made through official letters SETENA-DT-ASA-1883-2023 and SETENA-DT-ASA-2140-2023 (see the first report of the Secretary General of Nombre02 and the documentary evidence submitted).
  • 19)By Resolution No. 0186-2024-Nombre02 issued at 10:45 hours on 07 de febrero de 2024, Nombre02 ruled on the complaint filed by the appellant (see the second report of the Secretary General of Nombre02 and the documentary evidence submitted).
  • 20)On 07 de febrero de 2024, at 11:36 hours, the appellant was notified by email of Resolution No. 0186-2024-Nombre02 (see the second report of the Secretary General of Nombre02 and the documentary evidence submitted).

IV.Regarding the principle of prompt and effective justice (principio de justicia pronta y cumplida). In light of Article 41 of the Constitution, the Administration is obligated to guarantee the public prompt and effective justice without denial thereof. In the sphere of administrative justice, this entails its obligation to decide claims brought by members of the public diligently and expeditiously, so that its ruling is consistent with the matters alleged, and to notify the interested parties of its decision, all within a reasonable period. In this regard, whether the duration of administrative activity is “reasonable” is determined on a case-by-case basis according to various factors, such as the technical complexity of the administrative matter, the extent of the evidence to be taken, or the degree to which the challenged act affects the person or the environment. It follows that there is no strict right to the constitutionalization of time limits, but rather a right to constitutional review of those actions of the Administration for which there are insufficient grounds to justify the time taken to resolve a particular type of administrative matter.

V.Regarding the specific case. In the present matter, it may be inferred from the record that the appellant’s objection is limited to Nombre02’s delay in ruling on the expansion of the complaint initially filed in connection with the Residencias Lati project, processed under expediente D1-0092-2022-SETENA, which was granted environmental feasibility (viabilidad ambiental) through Resolution No. 551-2022-Nombre02 of 30 de marzo de 2022. It has been established that the project has the following characteristics: “3 one- and two-story homes totaling 1695 m2, with accessways, a swimming pool, green areas, and parking. Materials such as concrete, wood, glass, metal framing, ceramic materials, among others, will be used. During the construction phase, the project site will first be cleared and prepared, followed by construction. During the operational phase, the residences will be occupied and used.

The building coverage corresponds to 33,60% of the total survey plan area, and the remaining 66,40% will be maintained as a green area. Earthworks (movimientos de tierra) are contemplated, involving the hauling of volumes of up to 10.000 m3 outside the project area (AP). The earthworks will involve 2055,74 m3 of excavated material and 455,08 m3 of fill; these operations will be performed properly, and material removed from the project works area (AOP) will be handled by an authorized management provider, which will dispose of the material properly. Health and hygiene measures will also be implemented for the equipment used to remove material from the AOP. A system of proven efficiency, such as FAFA or improved tanks, will be used. The required setbacks between drainage systems and structures and the property boundaries will be observed. The area where the septic tank will be located shall not be rendered impermeable.”

It has been established that consecutive filing 04083-2023, concerning an environmental complaint filed by Ms. [Nombre01 001] against the project described above, was first received by Nombre02 on 20 de abril de 2023. In response to that filing, on 26 de abril de 2023, through official letter SETENA-DT-ASA-0791-2023, the project developer was asked to respond to the complaint within 10 business days. In addition, on 12 de mayo, the Departamento de Auditoría y Seguimiento Ambiental conducted a site visit to the project area to follow up on the complaint, as recorded in inspection report ASA-ACT-INS-0053-2022. Likewise, on 05 de abril de 2023, 29 de abril de 2023, and 09 de mayo de 2023, under digital-platform case numbers 17713, 17647, 18135, Mr. Daniel Loría Sims, the environmental manager (regente ambiental), submitted technical references in response to the complaint filed against the project, pursuant to official letter SETENA-DT-ASA-0791-2023, by which the complaint had been forwarded to the project developer.

Accordingly, on 1° de junio de 2023, through Resolution No. 0830-2023-SETENA, the complaint was partially upheld. Only the allegation concerning materials being washed onto the public roadway was partially upheld. This was based on the following: “the inspection visit indicated that, during the rainfall in March, the environmental measures intended to mitigate the washing away of the soil that still remained on the site as a result of the earthworks performed for the construction of the two homes currently at the shell-construction stage had not yet been installed. Although the earthworks had been completed and that soil had even been transported to a neighboring property, the fact remains that, during the rainfall, this residual material from the project area reached the public roadway; however, it was not the only source of the reported material, because another project involving substantial earthworks is located adjacent to the project covered by the referenced case file, and the complaint is therefore partially upheld.” The complaint was denied in all other respects.

The developer was also ordered to maintain the mitigation and control measures intended to prevent sediment from being washed away. It has been established that, on 08 de junio de 2023, a motion for reconsideration (recurso de revocatoria) filed by Mr. Álvaro Sagot Rodríguez, attorney-in-fact (apoderado) for the appellant, was received against the foregoing resolution. That objection was denied on 30 de agosto de 2023 through Resolution No. 1257-2023-SETENA.

With regard to the matters raised in this amparo proceeding (amparo), it has been established that, on August 18, 2023, tracking numbers 08202 and 08203-2023 were filed with Nombre02 concerning the submission of new evidence relating to the environmental complaint regarding irregularities in the aforementioned project, filed by Mr. Álvaro Sagot Rodríguez, attorney-in-fact for the petitioner. Accordingly, on August 28, by official letter SETENA-DT-ASA-1699-2023, the project developer was asked to respond to the expansion of the complaint within 10 business days, in compliance with due process (debido proceso). The corresponding response was received on September 13. On September 19, however, after analyzing the developer’s response, by official letter SETENA-DT-ASA-1883-2023, the Tempisque Conservation Area, National System of Conservation Areas, was asked, as evidence to facilitate adjudication (prueba para mejor resolver), to provide its technical opinion so that the complaint could be addressed.

That letter was received by said Area on October 02, and in it Nombre02 states and requests the following: “Report ACT-OSRC-201-2023 dated August 04, 2023, indicates in Table 1 the information concerning the survey plan numbers and owners of the properties under investigation. On page 7 of this report, it is stated ‘that this is a very large and complex case, given that it involves a parent property that was recently subdivided into several properties, making it necessary to overlay the survey plans of each property in order to determine on which properties each of the documented events occurred.’ With regard to the information cited in the preceding paragraph, since it is stated that the technical report applies to the 9 survey plans in Table 1, but does not specifically determine what pertains to the property on which the project under expediente D1-0092-2022-SETENA, Residencias Lati, is being developed, we require, and on the basis of the principle of interinstitutional coordination, request that SINAC inform this Secretariat of the following: 1.

Whether the work performed by the developer under survey plan P-2248092-2020, property number 244707-000, is located where earthworks (movimientos de tierra), terracing, and the opening of roads within a forest area are reported as having been observed, in accordance with the determination of the forest ecosystem in ACT-OSRC-197-2023. 2. Whether, based on the field inspections and the survey conducted, it can be determined that the observed changes in forest cover (cobertura forestal) correspond to the structures and roads of the project under survey plan P-2248092-2020, property number 244707-000. Technical report ACT-OSRPL-197-2023 dated July 27, 2022, Determination of Forest in Accordance with the Definition in Costa Rica’s Ley Forestal 7575, states on page 3, in the introduction section, that the study encompasses properties 6-244715-000, 6-244720-000, 6- 244718-000, 6-244709-000 and 6-2447708-000, excluding the property on which the project under expediente D1-0092-2022-SETENA, Residencias Lati, survey plan P-2248092-2020, property number 244707-000, is being developed; for this reason, we require you to indicate whether this property contains forest and whether such forest has been logged.” It is reported that on September 26, 2023, as part of the follow-up to judicial case 23-000028-0611-PE, in which the developer under survey plan P-2248092-2020, property number 244707-000, is identified as a possible defendant, the Tempisque Conservation Area conducted an expert assessment (pericia) to delineate the works and the impact on the forest on each of the properties investigated in that case.

Furthermore, between September 26, 2023 and November 23, 2023, it completed its analysis of the information collected and issued official letter ACT-OSRPL-641-2023 to Licda. Silvia Solís Dávila, Environmental Prosecutor, Deputy Agrarian and Environmental Prosecutor’s Office. Nevertheless, on December 05, 2023, official letter ACT-OSRC-274-2023 was issued, in which the Tempisque Conservation Area responded to official letter SETENA-DT-ASA-1883-2023 and stated the following:

  • 1)The work performed by the developer under survey plan P-2248092-2020, property number 244707-000, is part of the complaint concerning land-use change (cambio de uso del suelo) corresponding to case 23-000028-0611-PE.
  • 2)Technical report ACT-OSRPL-197-2023 excludes the property on which the project under expediente D1-0092-2022-SETENA, Residencias Lati, survey plan P-2248092-2020, property number 244707-000, is being developed, because, at the time the forest expert assessment was prepared, the preexisting cover at the indicated site had been altered and partially removed; therefore, it was not feasible to use that area as a control site for the study.
  • 3)The Code of Criminal Procedure provides in Article 295, Confidentiality of the proceedings (Privacidad de las actuaciones): ‘The preparatory proceeding shall not be public as to third parties. The proceedings may be examined only by the parties, either directly or through their representatives. Attorneys asserting a legitimate interest shall be informed by the Public Prosecutor’s Office of the matter under investigation and of any accused or detained persons, so that they may decide whether to participate in the case. The parties, officials participating in the investigation, and all other persons who, for any reason, have knowledge of the proceedings conducted shall be obligated to maintain confidentiality. Failure to comply with this obligation shall be deemed serious misconduct.’ Because this is a case under investigation and action is being taken under the functional direction of the Cóbano Prosecutor’s Office, this official is acting in compliance with Article 295 of the Code of Criminal Procedure. Por tanto, you are hereby informed that the reported events form part of an open judicial case that has been handled by the Cóbano subregional office and cannot be disclosed.” Nombre02 received that response on December 18, 2023. Consequently, by resolution No. 0186-2024-Nombre02 issued at 10:45 on February 07, 2024, it ultimately ruled on the complaint filed by the petitioner as follows: “FIRST: To dismiss in its entirety the complaint filed with Nombre02 on August 18, 2023, under tracking number 08203-2023, by Mr. Álvaro Sagot Rodríguez, attorney-in-fact for Ms. [Nombre01 001], against the Residencias Lati project under expediente D1-0092-2022-SETENA.” That ruling was served on the petitioner that same day.

The foregoing account establishes that both respondent authorities delayed processing and addressing the matters that fell to each of them in connection with the expansion of the complaint filed by the petitioner’s attorney-in-fact. Although SETENA was initially diligent in processing the matter and even promptly requested a technical opinion from the entity it deemed competent, it delayed issuing its decision on the merits. It should be noted that it received the aforementioned technical opinion on December 18, 2023, but did not issue resolution No. 0186-2024-SETENA, dismissing that expansion of the complaint, until February 07 of this year. As for the Tempisque Conservation Area, it was established that it received the request for a technical opinion on October 02, 2023, but did not issue it until more than two months later, specifically on December 05. In this regard, it is acknowledged that, because of institutional staffing shortages, the official in charge of the investigation also serves concurrently in two additional acting management positions at the Paquera-Lepanto and Cóbano subregional offices, which affects response times due to the heavy additional workload.

Although understandable, this situation cannot justify the delay in addressing Nombre02’s request, which contributed to the delay in deciding the matter because the requested opinion was still pending. Under the circumstances described, there is no doubt that the petitioner’s right to prompt administrative justice was violated, as the authorities were not diligent in processing the filing. That delay amounted to a denial of administrative justice; the respondent is therefore reminded of the Administration’s obligation to act in accordance with the principles of effectiveness, efficiency, simplicity, and promptness. The claim is therefore well-founded. Nevertheless, because the expansion of the complaint was decided, and the decision was served on the petitioner, as a result of this Chamber’s intervention, the appeal must be granted, as set forth below.

VI.Conclusion. Accordingly, because the constitutional violation has been established in the terms stated, the appeal must be granted against both respondent authorities, although without a specific award of costs or damages, since the expansion of the complaint filed by the petitioner’s attorney-in-fact has already been decided.

VII.On the award of costs and damages pursuant to Article 52 of the Constitutional Jurisdiction Act. Upon further consideration, the majority of the Chamber finds that, in the case under review (sub examine), pursuant to paragraph 1 of Article 52 of the Constitutional Jurisdiction Act (“If, while the amparo proceeding is pending, an administrative or judicial decision is issued that reverses, halts, or suspends the challenged action, the appeal shall be granted solely for purposes of compensation and costs, where appropriate”), the appeal should be granted without a specific award of costs or damages, based on the following considerations. Although the statute expressly requires the operative portion of the judgment to state that the appeal is granted when the grievance is resolved while the amparo proceeding is pending, it is equally true that the final clause of that same paragraph provides that the appeal is granted “solely for purposes of compensation and costs, where appropriate.” It is emphasized that the Act states “where appropriate,” which means that whether compensation and costs are appropriate depends on the Court’s evaluation, assessment, or weighing of the circumstances.

In cases such as this one, the substance of the protected person’s claim and the respondent authority’s conduct in acknowledging that claim suggest that the alleged impairments, injuries, or disruptions do not directly concern an impact on a constitutional right of an evident patrimonial nature (as would occur, for example, with an infringement of the right to salary). To dispel any doubt in this regard, it is important to emphasize Article 51 of the same Constitutional Jurisdiction Act, which provides that: “every decision granting the appeal shall impose an award in the abstract for compensation of the damages caused and payment of the costs of the appeal, with their quantification reserved for enforcement of the judgment”; this provision does not contemplate the possibility of assessing whether compensation and costs are appropriate. The principles of Constitutional Law, those of Public Law and General Procedural Law or, where applicable, those of International or Community Law and, additionally, in the stated order, the General Public Administration Act, the Code of Administrative Litigation Procedure, and the other procedural codes, are supplementary sources for the application and interpretation of the provisions of the Constitutional Jurisdiction Act—cf.

Article 14. For the administrative-litigation jurisdiction, the legislature established, in Article 197 of the Code of Administrative Litigation Procedure, a provision fully applicable to this case by analogy and consistent with procedural logic in all fields. In any event, the affected party in the present dispute (sub lite) retains the option, should she deem it appropriate, of bringing plenary proceedings (proceso de conocimiento) to demonstrate that she has suffered some form of harm. Based on the foregoing, the majority’s position is to decide this appeal without an award of costs or damages.

VIII.Note by Justice Castillo Víquez regarding prompt and effective administrative justice (justicia administrativa pronta y cumplida). I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the courts that must hear the legal dispute are the Contentious-Administrative Courts (Tribunales de lo Contencioso-Administrativo), rather than this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the amparo proceeding (recurso de amparo) established by article 32 of the Ley de la Jurisdicción Constitucional, in connection with article 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner considers that the Administration’s material actions, administrative acts (actos administrativos), or response are affecting the petitioner’s fundamental rights.

In my view, the recently enacted legislation does not mean that this Court should modify its line of precedent, since, pursuant to section 7 of its Law, it has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional cases and that may indeed be heard in this jurisdiction through the constitutional proceeding guaranteeing amparo, in all other cases, and for the reasons given by this Court (judgment No. 2008-002545 of 08:55 hours on 22 de febrero de 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction, all of which is consistent with section 25 of the Convención Americana sobre Derechos Humanos, Constitutional Law (Derecho de la Constitución) (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.

IX. NOTE BY JUSTICE CRUZ CASTRO

In the matter under examination (sub examine), the appellant states that on 18 de agosto de 2023 a complaint was filed with SETENA, which is being processed in expediente nro. D1-0092-2022-SETENA, PROYECTO RESIDENCIAS LATI. The appellant explains that the complaint concerns the unauthorized clearing of a forest in Cóbano for the purpose of constructing several residences. The appellant complains that this filing has neither been decided nor annulled and that Nombre02 has not protected the nation’s forests, thereby violating constitutional sections 50 and 89. The appellant contends that the environmental permit (licencia ambiental) issued must be annulled.

In this regard, the filing submitted by the protected person (persona amparada) on 18 de agosto de 2023 states:

“FIRST: In fact, because a forest existed, the environmental requirements should at the very least have been made more stringent by requiring the developer to submit the most rigorous environmental impact assessment (valoración de impacto ambiental), but this did not occur, and therefore our request for revocation (revocatoria) of the environmental permit should be granted.

In Full Commission Resolution No. 0830-2023-SETENA, the previous complaint was decided, stating that everything had been done in accordance with the law; that it was unnecessary to conduct an inspection before granting the permit, even though the LOA required it; that there had been no adverse environmental effects on the ecosystems; and that it was not for Nombre02 to assess the project site in order to determine whether or not a forest existed, etc.

But now, in light of the documentation we are submitting, everything we stated makes sense, and we request that restorative measures be taken and that the principle of the irreducibility of forests (principio de irreductibilidad del bosque) even be applied, pursuant to the principle of reversal of the burden of proof (principio de inversión en la carga de la prueba), because Dirección02, registered survey plan (plano catastrado) P-2248092-2020, is identified in the complaint as part of the forest in table 1 of the document entitled Inspection Report on Possible Forest Clearing and Land-Use Changes in Hermosa de Cóbano. Moreover, it is a forest in which access roads have even been built within the forest itself, and this has contributed to the environmental damage that we have discussed since the initial complaint.

It is evident that, had the mandatory inspection required by the LOA provision been conducted, the reported circumstances would have been detected. This also involves the environmental permits issued for projects located in the immediately surrounding area, which you must also analyze so as not to become participants in environmental damage.

The determination that no forest existed in the project area was entirely false, and the truth is that no decree of national interest (decreto de conveniencia nacional) ever existed. We therefore request that administrative sanction proceedings (procedimientos administrativos sancionatorios) be opened against the professionals involved and the project managers. We request that the environmental permit be canceled and that ecosystem restoration (restauración ecosistémica) be ordered.

The principle of reversal of the burden of proof requires immediate action by suspending the environmental permit, and we request that this be ordered, because otherwise Nombre02 itself would be participating in environmental damage.

Along the same lines, let us recall that our Ley de la Biodiversidad even provides in section 8 of that statute, which is linked by connection to constitutional section 50, that private property must fulfill an environmental function, but apparently in this case the relevant aspects of the project were not assessed. Consequently, a land-use change (cambio de uso del suelo) has occurred that requires application of the principle of the irreducibility of forests so that conditions may be restored to what previously existed through the corresponding restoration processes.

Consistent with the foregoing, we consider that the environmental permit conflicts with section 49 of the Ley de la Biodiversidad, because biodiversity has been neglected by allowing, without oversight, indiscriminate clear-cutting (tala rasa), without criteria or technical assessments, at a site that had clear forest cover (cobertura boscosa) and forest suitability (vocación forestal), as shown by the photographs initially submitted by us and by the SINAC forest determination (dictamen de bosque) attached hereto.

Section 17 of the Ley Orgánica del Ambiente and section 92 of the Ley de la Biodiversidad clearly establish the State’s obligation to conduct environmental impact assessments (evaluaciones de impacto ambiental) when activities entail environmental impacts on biodiversity. Although an assessment did exist here, the fact remains that it did not address every aspect, and therefore circumstances arose that conflict with the law and give rise to grounds for absolute nullity (vicios de nulidad absoluta), because the use of the forest land was changed to residential use, as we have been arguing. As to the foregoing, there were NO assessments of the impacts resulting from the loss of ecosystems at a site now known to be a forest. Worse still, SETENA never conducted even a single inspection, thereby violating the statutory duty established in article 84 of the Ley Orgánica del Ambiente, as we stated.

Accordingly, the permit contains defects (vicios) in the content and grounds of the enabling act (acto habilitador), due to the absence of essential elements. Those defects cannot be cured merely by stating that the consultants’ reports were believed, because here, as we have said, we are dealing with duties expressly established by the Ley Orgánica del Ambiente itself. Moreover, the Ley General de la Administración Pública itself provides in section 132:

"Article 132.- l. The content must be lawful, possible, clear, and precise, and must address all factual and legal issues arising from the grounds, even if they have not been debated by the interested parties. 2. It must also be proportionate to the statutory purpose and correspond to the grounds, when both are regulated... " Because the mandatory inspection—that is, the inspection required by law—was omitted, it is evident that NO studies were included that clearly weighed all factual and legal circumstances, and that failure to comprehensively assess statutory obligations may have led to the unlawful procurement, through the permit, of an authorization that changed the land use in the project area.

The permit stated the following as justification for not conducting the inspection:

"Having reviewed the information contained in administrative expediente Dl-00922022-SETENA and analyzed the project’s location according to the report issued by the Geography Area, thereby complying with the provisions of Decreto Ejecutivo NO 31849MINAE-S-MOPT-MAG-MEIC and its amendments, the Environmental Assessment Department determined that it would not conduct a field inspection. The following are additional factors supporting this decision: l. The nature of the project. 2. The proposed project’s compatibility with its surroundings. 3. The environmental-impact significance obtained in Environmental Assessment Document Dl. 4. The availability of a photographic record of the project area. 5. The conclusions of the studies attached to the assessment instrument do not identify specific indications requiring further examination and confirmation through a field inspection" In light of the SINAC information now being submitted to you, together with the failure to inspect and to review orthophotographs from months earlier showing the existing forest, it is clear that there was never an analysis of the actual surroundings or of the environmental-impact significance. This results in the permit’s nullity and also provides grounds for initiating actions against the project designers and consultants.

As we have stated, the cumulative effect of the irrational forest clearing carried out by all the projects located in the forest on the neighboring properties was NEVER assessed. We therefore request the absolute nullity of the environmental permit, because the content and grounds of the environmental permit unquestionably contain defects.

Section 14 of the Convención sobre la Diversidad Biológica (Ley No 7416) provides that environmental impact assessments must be extremely rigorous so that only minimal adverse environmental impact occurs. But if it was accepted as true that no forest existed, when it did and still does exist according to SINAC, then the company and the consultants must assume the responsibility they bear here today. We therefore request application of the relevant rules, including the duly ratified treaty provisions.

Regarding the fundamental criteria for granting the revocation of an environmental permit and declaring nullity for violation of the principle of scientific environmental protection (principio de tutela científica), see, for example, decisions 200514293 and 2006-17126, in which the Constitutional Chamber itself follows this approach:

"Regarding the objectification of environmental protection (objetivación de la tutela ambiental): as this Court stated in judgment number 14293-2005, at fourteen hours and fifty-two hours on diecinueve de octubre del dos mil cinco, this is a principle that cannot in any way be confused with the preceding principle [referring to the precautionary principle (principio precautorio)], insofar as, deriving from the provisions of sections 16 and 160 of the Ley General de la Administración Pública, it entails the need to support decision-making in this field with technical studies, both in relation to acts and to provisions of a general nature—whether statutory or regulatory—from which arises the requirement of ‘adherence to science and technology,’ thereby constraining the Administration’s discretion in this field. Thus, based on the results derived from those technical studies—such as environmental impact studies (estudios de impacto ambiental)—if objective technical criteria demonstrate the probability of evident harm to the environment, natural resources, or human health, the proposed project, work, or activity must be rejected; and where there is ‘reasonable doubt,’ decisions must be made in favor of the environment (pro-nature principle (principio pro-natura)), which may result in the adoption of both compensatory and precautionary measures in order to protect the environment adequately." (Emphasis added) That is, as we have explained, even where there is doubt as to the best course of action, everything should favor rejecting the project as carried out to date; in other words, the environmental authorization act (acto habilitador ambiental) must be declared absolutely null and void so that the necessary, timely, and restorative measures may be taken.

Indeed, in a recent ruling (2022), the Constitutional Chamber addressed the principle of objectification (principio de objetivación):

“The Chamber’s case law has repeatedly held that legislative powers must be linked to unequivocal rules of science or technology and to elementary principles of justice, logic, or expediency when the object of legislative activity concerns environmental matters, given that the principle of objectification of environmental protection has been consistently applied by constitutional case law (judgments N 2010-000075 at 15:01 hours on 6 de enero de 2010, 2012-013367; at 11:33 hours on 21 de setiembre de 2012, 2013-005964 at 15:05 hours on 30 de abril del 2013 and 2018-007978 at 12:45 hours on 18 de mayo de 2018.)” Voto No 2022025307 at thirteen hours and forty minutes on veinticinco de octubre de dos mil veintidós.” (Emphasis added) In light of the foregoing, it is clear that the report submitted by the biologist conflicts with SINAC’s information, and that lack of sound judgment subsequently served as the basis for Nombre02 to endorse the questionable environmental license (licencia ambiental). However, everything done by the consultants is tainted by violations of legality, transparency, constitutionality, and the principle of scientifically grounded protection (principio de tutela científica), which must unquestionably lead to revocation of the license and the commencement of sanctioning proceedings (órganos sancionatorios).

Furthermore, it must be borne in mind that ANNEX 3, within the GENERAL REGULATIONS ON ENVIRONMENTAL IMPACT ASSESSMENT PROCEDURES (REGLAMENTO GENERAL SOBRE LOS PROCEDIMIENTOS DE EVALUACIÓN DE IMPACTO AMBIENTAL) (environmental impact assessment [evaluación de impacto ambiental, EIA]), Decreto Ejecutivo No. 31849-MINAE-S-MOPT-MAGMEIC of 24 de mayo del 2004, published in La Gaceta No. 125 of 28 de junio del 2004, provides:

“ENVIRONMENTALLY FRAGILE AREAS: By their nature, the AAE are divided into two main groups: a) those areas for which the State has defined a special use regime (a defined legal and technical framework); b) geographic areas presenting technical and environmental limitations on their use... 10. Maritime-terrestrial zone. 11. Areas with natural forest cover (cobertura boscosa), (Emphasis added) For all these reasons, we request revocation of the environmental license and, pending such revocation, we respectfully request that the effects of the license be suspended pursuant to the precautionary principle (criterio precautorio), the preventive principle (principio preventivo), and reversal of the burden of proof (inversión de la carga de la prueba).

SECOND: Furthermore, as stated by the municipality, thousands of cubic meters of soil (10.000 mil or more) were found to have been removed from the property, which to date were not assessed by Nombre02. This entails circumstances that unquestionably jeopardize the ecosystem, soil resources, biodiversity, and, of course, the environmental license; accordingly, we request that the license be revoked for such serious violations.

It should be noted that the municipal complaint itself, dated 8 de agosto de este año, states that there is currently a HIGH potential for further landslides and therefore requests the IMMEDIATE intervention of Nombre02, which should take more forceful action because, despite the existing slope, a swimming pool is even being built, adding further weight to the hillside.

It is important for this Authority to state that the cut slopes (taludes) were NOT authorized under the environmental license, nor were the other mitigation or prevention works; therefore, the project is entirely unlawful, harmful to the environment, and dangerous to human life and public property, such as the road located beneath what was once a large forest (bosque).

THIRD: Finally, we were unable to find in Nombre02’s case file (expediente) an assignment of the original developer’s environmental feasibility (viabilidad ambiental) to the current developer, which constitutes yet another irregularity, and we request that it be so determined.

(…)

RELIEF SOUGHT In consideration of all the foregoing, we request the following:

- That an investigation be conducted by SETENA’s environmental audit and monitoring unit.

- That the environmental license be declared absolutely null and void due to defects of legality, given that the project’s environmental feasibility should also have been assessed using more stringent environmental requirements and other instruments and methodologies.

- That it be declared that a project to be carried out on a forest site should have been screened under Nombre02’s most rigorous assessment standards, but this did not occur and therefore warrants granting the request to revoke the environmental license.

- That it be declared that, due to the project designers’ irresponsibility, the thousands of cubic meters that were to be removed from the project were never environmentally assessed, which is highly irregular.

- That it be declared that the mitigation works and the high potential for landslides were never assessed by SETENA.

- That suspension of the environmental license be ordered while this complaint is reviewed.

- That it be declared that the only works permitted shall be those intended to remedy, restore, and mitigate the adverse environmental impacts caused.

- That the Lati project’s environmental bond (garantía ambiental) be applied to the corresponding demolition and that the funds be allocated to remedying the damage caused to the ecosystem. That it be declared that the consultants’ information misled SETENA. That it be declared that SINAC’s complaint makes clear that even the access road to the project is located in a forest.

- That administrative sanctioning proceedings (expedientes administrativos sancionatorios) be initiated against the environmental consultants involved and against the company for having provided data and contradictory or inaccurate reports that served only to enable the project to obtain environmental feasibility.

- That the Concejo de Distrito de Cóbano be informed of the decision so that it may proceed to annul the construction permit.

- That the Concejo de Distrito de Cóbano be informed that the project must be suspended immediately as a precautionary measure.

- That the demolition of this project be ordered.

- That investigations be initiated and all projects on neighboring properties be ordered halted, followed by the revocation of all environmental licenses for those other projects.

PROCEDURAL MATTERS INTERIM RELIEF (MEDIDA CAUTELAR): MOTION TO SUSPEND THE ENVIRONMENTAL LICENSE INITIALLY, the Comisión Plenaria must immediately be informed of this new evidence, which is now being submitted, so that it may decide the appeal filed against the analysis conducted in connection with the first complaint.

Based on the foregoing and the environmental and social risk described, we hereby file a motion for suspension (incidente de suspensión) of the environmental license until this petition is resolved, given the danger and the potential impacts on biodiversity if the project proceeds at a site considered highly environmentally fragile because a forest exists there.

FIRST.—Prima facie case (apariencia de buen derecho): As we have argued and substantiated with information, it is clear that numeral 17 of the Ley Orgánica del Ambiente has been violated because the project was not rigorously assessed and because reports from the consultants that misled SETENA officials are also in the record.

The case law of the Tribunal Contencioso Administrativo has stated the following regarding the application of environmental-law principles:

“Within this field, this Court is aware of the extensive legislation governing the protective framework for the environment, as well as the significant case law issued on the subject by the Constitutional Chamber. Moreover, it is clear that, in this context, principles such as in dubio pro natura, precaution, prevention, polluter pays, and restoration in kind (reparación in natura), among others, constitute tools of paramount importance that must be weighed by the adjudicator in each particular case so as not to render the right contained in the aforementioned ordinal 50 ineffective. Thus, in the environmental context, the cited requirements must be assessed in accordance with the content of the principles permeating environmental law; otherwise, that right could be stripped of its substance and environmental damage permitted through omission...” Resolución número: 250-2010 at 8:00 hours on 29/01/2010, Tribunal Contencioso Administrativo, Sección VI.

The Report on the inspection and complaint concerning forest clearing (tala de bosque) and land-use changes (cambios de uso) in Hermosa de Cóbano, submitted by SINAC to the Fiscalía, states that the property on which the project is located is a forest site. Indeed, the complaint states:

“During the inspection conducted on 12 de junio de 2023, the indicated sites and those adjoining expediente Nombre02 D1-00092- 2022 were visited, and multiple earthworks (movimientos de tierra), terrace formation, and road opening in a forest area were observed, in accordance with the forest ecosystem determination ACT-OSRC-197-2023. The road appears on the plans as a right-of-way easement (servidumbre de paso); however, it appears to have been constructed in a forest area. The works apparently are being carried out on the various properties mentioned in table 1 and share access through the road that was opened and identified on the plans as a right-of-way easement. Based on the field inspections, during which information was collected using a Garmin GPSmap 64s GPS signal receiver, and satellite imagery from the Planet Explorer server, the observed changes to the site’s forest cover caused, possibly, by the construction works and the road were delineated.

This information was overlaid on the available imagery from the years of the project: Carta del año 2005, Ortofotos 2014-2017, Google Earth diciembre 2021 and Planet Explorer de febrero 2023 ... This information processing identified a possible impact on approximately 13.070,22 square meters of forest... likewise, the road used as a right-of-way easement can be seen without cover...” The felling of the large number of trees reported by the municipality should be observed and assessed, as it further supports the prima facie case that we have argued.

Moreover, if there is any doubt regarding the site’s status as forest, we request that the principle of reversal of the burden of proof nevertheless be applied and, if necessary, that clarification be requested from SINAC.

Take note of the provisions of the Ley Forestal violated by the land-use change (cambio uso del suelo), as well as the aggravating circumstance posed by the destruction of ecosystems.

Accordingly, the prima facie case requirement is satisfied because there are factual circumstances, legal rules, and principles of environmental law supporting the requested measure.

SECOND.—Danger in delay and serious harm: The periculum in mora requirement must be based on the harm that the environment could suffer, weighed above private interests or those of the Public Administration itself. In this case, as stated supra, there is an imminent risk of harm to water resources, the forest, the landscape, and biodiversity.

At the Bergen Conference on Sustainable Development, the following was stated in discussing the precautionary principle:

“...it is preferable to be more or less correct, but in time, given the serious consequences of a major mistake, than to be precisely correct once it is already too late...” (Rodrigo Walsh et al. 2000. “Ambiente, derecho y sustentabilidad” Editorial La Ley. Argentina) Emphasis not in the original.

The Administrative Courts have stated regarding this requirement: “Now then, it is clear that the harm required for interim relief (amparo cautelar) must be actual and real, regardless of whether it is material, moral, or of another nature. Although it need not be present harm, since it may well be potential—that is, future harm—the harm must certainly be concrete and certain.” Decision number: 250-2010 of 8:00 hours on 29/01/2010, Administrative Litigation Court, Section VI. (emphasis added) The danger in delay (peligro en la demora) is also demonstrated by the municipality’s statement regarding the HIGH POTENTIAL for landslides that exists even now, in August 2023.

THIRD.- Balancing of the interests at stake (ponderación de intereses en juego): In this case, it is essential to halt the entire approval proceeding until this appeal and the motion to annul the environmental permit (incidente de nulidad de la licencia ambiental) are decided, since otherwise MORE environmental harm could be continuously caused to the ecosystems.

It has been judicially held: “The challenged act possesses the characteristics noted in previous recitals (considerandos); that is, it is a precautionary measure (medida cautelar) aimed at protecting a legally protected interest of constitutional and international rank, namely the environment. It must be clearly understood that the parameters established in the legal system for adopting these measures are special, reiterating what was stated above: actions taken by the State must always be directed toward protecting the environment, even when there may be doubt as to whether the exercise of the private party’s right—which would be limited by the measure—was the direct cause of the possible impact on the element at risk.” Decision number 53-2009 of 15:20 hours on 30/06/2009, Administrative Litigation Court, Section IX.

It should be noted that the existence of completed homes with people living in that forest ecosystem is a factor that affects the forest and its recovery. Likewise, it is clear that the principle of non-reduction of the forest (principio de irreductibilidad del bosque) is being violated.

We request that the new evidence be reviewed and assessed, as it supplements everything we have stated and demonstrates the need to order the suspension of the construction work NOW.

REGARDING THE INITIATION OF ADMINISTRATIVE SANCTIONING PROCEEDINGS With respect to the initiation of administrative sanctioning proceedings (procedimientos administrativos sancionatorios), we request that we be recognized as qualified complainants (denunciantes calificados) and that we be notified of all relevant matters.

The Constitutional Chamber has stated regarding qualified complainants:

“A qualified complainant may hold a legitimate interest (interés legítimo) or a subjective right (derecho subjetivo), and therefore, in accordance with the most modern doctrine of Administrative Law, must be deemed, for all purposes, an interested party (parte interesada) in the respective administrative proceeding. Because that qualified complainant has the status of an interested party, the complainant is entitled to all the rights associated with that status and, specifically, to the rights to due process and a defense, and must therefore have an effective opportunity to submit arguments, offer evidence, participate in the production thereof, and appeal any interlocutory decision having independent effects or any final decision that may be issued. Denying a qualified complainant the status of a party and, consequently, the opportunity to exercise due process and a defense flagrantly violates the Right of NO 2015002787) All of the foregoing is relevant because there is a clear obligation to comply with the rules and procedures; however, the reports contain information already disproven by SINAC that is not supported by science and technical expertise, all contrary to the regulatory provisions governing consultants’ duties.

The REGLAMENTO GENERAL SOBRE LOS PROCEDIMIENTOS DE EVALUACIÓN DE IMPACTO AMBIENTAL (EIA), Decreto Ejecutivo No. 31849-MINAE-S-MOPT-MAG-MEIC, provides that environmental consultants bear responsibility for breaches of duties under provisions 76, 83, 102, and the following and related provisions, which we respectfully request be applied. We request that the consultants be sanctioned by removal from the registry (desinscripción) for the circumstances set forth in provision 100, subsections 1 and 2. Finally, we request enforcement of the environmental bond (garantía ambiental) pursuant to provision 92 of the cited regulations.” With regard to the foregoing, that body determined in decision no. 186-2024-Nombre02 of 10:45 hours on 7 de febrero de 2024:

“LATI RESIDENCES PROJECT ADMINISTRATIVE FILE Nº D1-0092-2022-Nombre02 The Plenary Commission of this Secretariat considers technical report INF-TEC-DT-ASA-0042- 2024, dated 25 de enero del 2024, concerning the project: Residencias Lati, file: D10092-2022-Nombre02 (…)

RECITALS FIRST: That, pursuant to Article 282 of the Ley General de la Administración Pública (LGAP) Nº 6227, and based on the documentation submitted to the file, Sivan Cibulski, identification document CED06, and legal representative Flor Rivas León, identity card CED02, are recognized as having standing, the latter acting as the legal representative of Magna Pacific Sociedad de Responsabilidad Limitada, identity card CED03, to participate in the proceeding.

SECOND: That Article 16 of the Ley General de Administración Pública N° 6227 establishes that:

“Under no circumstances may acts be issued that are contrary to the unequivocal rules of science or technical expertise, or to elementary principles of justice, logic, and sound judgment….” THIRD: That Article 19 of the Ley Orgánica del Ambiente N° 7554 stipulates:

“The decisions of the Secretaría Técnica Nacional Ambiental must state their grounds and reasoning. They shall be binding both on private parties and on public entities and bodies.” FOURTH: Decreto Ejecutivo Nº 43898-MINAE-S- MOPT-MAG-MEIC, in Article 56, establishes:

“Environmental complaints filed against an activity, construction work, or project during the environmental impact assessment (Evaluación de Impacto Ambiental) stage or the environmental monitoring (seguimiento ambiental) stage must be submitted through the official digital channels. Nombre02 shall process only those complaints falling within its jurisdiction, as established in the respective environmental viability decision (resolución de viabilidad ambiental).” In light of the foregoing, a response shall now be provided to the complaint filed against the project.

FIFTH: The complaint alleges the following facts:

Fact 1. In fact, given the existence of forest, the environmental requirements should at least have been made more stringent by requiring the developer to submit the most rigorous environmental impact assessment; however, this did not occur, and therefore our request to revoke the environmental permit should be granted.

Fact 2. Moreover, as stated by the municipality, thousands of cubic meters of earth (10.000 mil or more) were found to have been removed from the property, which to date have not been assessed by SETENA. This involves circumstances that unquestionably jeopardize the ecosystem, soil resources, biodiversity, and, of course, the environmental permit; we therefore request that the permit be revoked due to such serious violations.

Fact 3. Finally, we were unable to locate in the Nombre02 file any assignment of environmental viability (cesión de la viabilidad ambiental) from the original developer to the current developer, which further contributes to another irregularity, and we therefore request that it be so determined.

SIXTH: The evidence submitted in response to the complaints is as follows:

Fact 1: This allegation is directed at SETENA and requests that it revoke the environmental permit. However, we wish to clarify that the Developer and our Client submitted, as part of the environmental impact study (estudio de impacto ambiental), all requirements and studies necessary to obtain environmental viability in accordance with the regulations governing this type of project. Furthermore, the very evidence submitted by the complainant (SINAC Report), which lists the properties located in forest areas, does not include the property in the Province of Puntarenas recorded under real-property folio 244707-000—or cadastral plan number The ACTOSRC-20l -2023 report, cited by the complainant among the new evidence, indicates that the exact location of the property examined is as follows: The site is located in the district of Lepanto, in the central canton of the province of Puntarenas, specifically in the hamlet of Hermosa in the district of Cóbano, in the central canton of the province of Puntarenas, and may comprise the following properties: 6-244707-000, 6-244715-000, 6- 244720-000, 6-244718000, 6-244709-000, 6-244708-000, 6-149464-000, 6-45156-000, 6- 151812-000; in other words, the report encompasses a total of nine properties, unequivocally demonstrating that the study and subsequent report are not focused solely on determining the conditions of the Residencia Lati Project, as the complainant would have others believe.

In addition to the foregoing, we must note that the introduction to report ACT-OSRPL-197-2023 states: This document contains the documentary, geospatial, and field evidence collected to determine whether the site sampled at Dirección03, in the district of Cóbano, central canton of the province of Puntarenas, between coordinates 369678 - 1068900 and 369953 - 1068700, CRTM05 projection system, comprising properties Dirección04, 6244720-000, Dirección05, Dirección06, and Dirección07, omitting any mention of property Dirección08.

(…)

Fact 2: The assertion that the project carried out earthworks (movimientos de tierra) involving more than ten thousand cubic meters (10.000m2) is entirely incorrect. The project carried out the earthworks in accordance with the environmental assessment application (solicitud de evaluación ambiental). The assertion that the Developer moved such a quantity of earth appears malicious, because the Residencia Lati project confined itself to the earthworks specified in the environmental assessment approved by SETENA. Through inspection reports prepared by its own staff, the municipal authority having jurisdiction itself determined that the quantity of earthworks in m3 could not be quantified. The reports further state that other adjacent projects carried out significant earthworks; however, they omit a fact conclusively demonstrated by the municipal authority itself and documented in reports prepared by technical personnel from the Municipality itself and SINAC.

Furthermore, Resolución N° 1257-2023-SETENA, which is based on an inspection conducted by professionals from that institution, states: “It is determined that the Lati project is not the only construction project located at the site, since there is a project in the eastern sector that is completing earthworks and installing mitigation measures (medidas de mitigación) to prevent material runoff; therefore, that project may also have contributed to the impact on the public roadway during the month of March. (underlining added).

(…)

Fact 3: Regarding this allegation, we must clarify that the Developer and the party responsible for the Project remain the same as identified in Resolución 551-2022-SETENA, Proyecto Residencia Lati, administrative file number D1-0092-2022, in the name of Nombre01 of Nombre03.

OTHER CONSIDERATIONS INCLUDED IN THE COMPLAINT.

CONSIDERATION 1.-LAND-USE CHANGE (CAMBIO DE USO DEL SUELO) AT THE TIME THE ENVIRONMENTAL PERMIT FOR THE PROJECT WAS GRANTED.

The land-use certificate (uso de suelo) issued by the Concejo municipal de Cóbano through official letter ING-US412-2021 states that the plan in question is NOT subject to any zoning plan (plan regulador) and that residential land use COMPLIES with the regulations governing subdivisions and urban developments (reglamento de fraccionamientos y urbanizaciones). Accordingly, RESIDENTIAL AND COMMERCIAL land use was authorized, subject to the corresponding requirements concerning minimum lot area, minimum frontage, building footprint, maximum height, setback lines, roadway protection, and setbacks; all of these requirements have been observed in the development of the project. Therefore, no land-use change has occurred.

CONSIDERATION 2- INDISCRIMINATE TREE FELLING DOCUMENTED BY REPORT AND PHOTOGRAPHS. The project has a forestry certification prepared on November 11, 2021 (before construction began), certifying several types of land cover (cobertura), including 2200 m2 of land designated for agricultural use without forest (terreno de uso agropecuario sin bosque), where most of the project’s infrastructure footprint, corresponding to the residential houses, is located. See EXP: D1-0092-2022-Nombre02 Response—ENVIRONMENTAL PLANNING AND DESIGN. The assertion that the Residencia Lati Project engaged in unauthorized tree felling (tala no autorizada) is incorrect because no indiscriminate tree felling (tala indiscriminada) was carried out; the trees that had to be cut fell within diameter classes of less than 15 centimeters DBH (DAP), or were exotic species that did not require a tree-felling permit (permiso de corta).

For trees whose cutting required a permit, the permits were processed by submitting an application for a tree-felling permit to the SINAC subregional office in Cóbano, which granted authorization to cut 1 Guácimo and 1 Chaperno on land designated for agricultural use without forest through resolution ACT-OSRC-010-2023.

Additionally, other actions consisting of tree pruning were carried out, for which no permit from the State Forestry Administration (Administración Forestal del Estado) is required.

There is evidence of indiscriminate tree felling in neighboring projects, acts that were promptly reported by ENVIRONMENTAL PLANNING AND DESIGN in the complaint filed on April 12, 2023, before Nombre02, to which no response has yet been received. However, it is evident that the complainant seeks to minimize the noncompliance and impacts caused by other projects in the area adjoining the Residencia Lati Projects, while directing its entire arsenal against the Residencia Lati Project.

CONSIDERATION 3—REQUIRE RESTORATION MEASURES AND APPLICATION OF THE PRINCIPLE OF FOREST NON-REDUCTION (PRINCIPIO DE IRREDUCTIBILIDAD DEL BOSQUE).

Response—ENVIRONMENTAL PLANNING AND DESIGN. The forest was not reduced; the infrastructure’s greatest impact occurred on land designated for agricultural use without forest, as stated in the forestry certification issued on November 11, 2021, and recorded in the SETENA case file.

CONSIDERATION 4—ACCESS ROADS HAVE BEEN BUILT WITHIN THE FOREST ITSELF, CAUSING ENVIRONMENTAL DAMAGE Response—ENVIRONMENTAL PLANNING AND DESIGN. The property where the Residencia Lati Project is located has a duly registered access easement (servidumbre de acceso), as evidenced by the property’s literal certification (certificación literal). There is no evidence that the Developer cleared forest to establish any new access road to the Project. Satellite imagery does not make it possible to determine whether changes in land cover occurred as a result of constructing the easement because it is covered by the canopy of the surrounding trees.

CONSIDERATION 5—THE DETERMINATION THAT NO FOREST EXISTED IN THE PROJECT AREA WAS ENTIRELY FALSE Response—ENVIRONMENTAL PLANNING AND DESIGN. The reports prepared by SINAC under resolution numbers ACT-OSRC-201-2023 and ACT-OSRPL-197-2023 determined the presence of areas meeting the definition of forest in surrounding areas that do not directly correspond to the Residencia Lati Project area. This is evident in all the maps presented, which identify an area of influence vastly larger than the area encompassed by the Residencia Lati Project.

The area marked with the red arrow is where the Residencia Lati Project is located; accordingly, the sector identified in the SINAC resolutions and by the municipal authority encompasses other projects neighboring Residencia Lati.

It must be clarified that land-cover analysis based on satellite imagery makes it possible to identify areas with forest cover (cobertura forestal), but does not reliably distinguish among different types of forest cover, particularly when medium- or low-resolution imagery is used. Furthermore, the forestry certification issued on November 11, 2021, clearly states that an area where the Residencia Lati Project was developed consisted of pastureland with scattered trees, some of which were exotic species with diameters greater than 50 cm at a height of 1.30 m, specifically specimens of Gmelina arborea, Melina. This demonstrates that this sector of the property was disturbed more than 30 years ago and constitutes reliable evidence that the land cover in the project area was altered before the Ley Forestal entered into force and before the prohibition on land-use change (cambio de uso del suelo).

CONSIDERATION 6—CLEAR-CUTTING WITHOUT CRITERIA OR TECHNICAL ASSESSMENTS AT A SITE THAT CLEARLY HAD FOREST COVER AND FORESTRY SUITABILITY.

Response—ENVIRONMENTAL PLANNING AND DESIGN. “Clear-cutting” (tala rasa) was never carried out in the Residencia Lati Project. The complaint also introduces photographs as evidence in a misleading manner because it includes photographs from the SINAC report, which covers areas that do not correspond to the Residencia Lati Project but rather to the entire area assessed by ACT inspectors in preparing their report, involving nine properties analyzed to substantiate the report that was incorporated into the complaint against Residencia Lati. This compels us to point out that there is either error or bad faith when images are submitted of projects having no relationship to Residencia Lati.

The tree cover shown in the satellite images cannot be directly associated with forest cover as defined by the Ley Forestal. A technical assessment had previously been conducted, resulting in a forestry certification that classified the types of land cover present in the Residencia Lati Project. It is important to note that the photographs of the reported acts showing tree stumps at the site do not correspond to areas within the Residencia Lati Project but belong to an adjoining project identified as Hermosa Mountain House SRL.

CONSIDERATION 7—THERE WAS NEVER AN ANALYSIS OF THE ACTUAL SURROUNDINGS OR OF THE ENVIRONMENTAL IMPACT, WARRANTING THE INITIATION OF ACTIONS AGAINST THE PROJECT DEVELOPERS AND CONSULTANTS.

Response—ENVIRONMENTAL PLANNING AND DESIGN. In accordance with the Manual of Technical Instruments for the Environmental Impact Assessment Procedure: Part II, Decreto Ejecutivo No. 32712-MINAE, the Developer, through the environmental consultant, prepared and submitted the geological, biological, archaeological, forestry, and engineering protocols, together with the other requested documentation, fully complying with the environmental assessment legislation in force on the date the case file was submitted; otherwise, the Residencia Lati Project would not have obtained the environmental approval (viabilidad ambiental) granted by SETENA in resolution 551-2022-SETENA.

CONSIDERATION 8. IRRATIONAL CLEARING OF THE FOREST BY PROJECTS LOCATED ON ADJOINING PROPERTIES; WE THEREFORE REQUEST THAT THE ENVIRONMENTAL LICENSE BE DECLARED ABSOLUTELY NULL AND VOID.

Response—ENVIRONMENTAL PLANNING AND DESIGN. Through the allegations in its complaint, the complainant seeks to attribute all responsibility to the Residencia Lati Project, which, it bears mentioning, is the only project with the required signage and environmental monitoring; this is not the case for neighboring projects. The Residencia Lati Project obtained the tree-felling permits issued for the project by the Cóbano subregional office and did not cut any species requiring a permit without the corresponding authorization.

CONSIDERATION 9. MUNICIPAL REPORT INDICATING THAT THOUSANDS OF CUBIC METERS OF EARTH (10 000 THOUSAND OR MORE) WERE REMOVED FROM THE PROPERTY.

R—ENVIRONMENTAL PLANNING AND DESIGN. During the environmental assessment process, the Sworn Declaration on earthworks (Declaración Jurada sobre movimientos de tierra) was submitted, stating that the volume of earth to be excavated for the project in question was 2055,74 m3 and that a volume of 455,08 m3 would be used as fill. It also states that the Project does not require demolition and that, consequently, only a negligible volume of debris would be transported outside the project, apart from that generated during the construction process. This volume is far less than the stated 10 000 m3, and earthworks of that magnitude never occurred, although the SETENA resolution included that quantity as authorized. According to the Sworn Declaration on earthworks, the generated material was transported to the OB Hermosa Properties Ltda project, corporate identification number CED04. Furthermore, it is important to emphasize that the earthworks and the removal of material from the project area (área del proyecto, AP) occurred in November 2022, while the events occurred in March 2023; therefore, by that date there were no accumulations of earth within the project that could have been washed away by rain.

CONSIDERATION 10. THE SLOPES WERE NOT AUTHORIZED IN THE ENVIRONMENTAL LICENSE; THE PROJECT IS THEREFORE ENTIRELY ILLEGAL, HARMFUL TO THE ENVIRONMENT, AND DANGEROUS TO HUMAN LIFE AND PUBLIC PROPERTY, SUCH AS THE ROAD LOCATED BELOW WHAT WAS ONCE A LARGE FOREST.

Response—ENVIRONMENTAL PLANNING AND DESIGN. During the environmental assessment process before Nombre02, all requirements were met, and the soil and slope-stability study (estudio de suelos y estabilidad de taludes), prepared by Perforaciones y consultorías Hidrotécnicas S.A. in September 2021, was submitted. The conclusions of that report state: “...it is concluded that the lowest safety factor is: 3.5 under pseudostatic conditions, which indicates that, in relation to the minimum permitted under the Costa Rican Foundation Code (FS >2 without earthquake), the project area exhibits stable-condition ranges as a block.” The Soil Study formed part of the environmental assessment process before SETENA and is therefore part of the environmental approval granted to the project. The complainant’s assertion that the slopes were not considered in the assessment is untrue.

CONSIDERATION 11—REGARDING THE NATURAL HAZARDS FACING THE PROJECT.

Response—ENVIRONMENTAL PLANNING AND DESIGN. In the integrated geology protocol submitted to Nombre02 as part of the Environmental Assessment process, specifically in the chapter containing data on natural hazard and risk conditions, the responsible geologist, Marco Araya Oviedo, states: “The Map of Potential Natural Hazards for the Río Arío Sheet (CNE, 2002) and the Map of Potential Natural Hazards for the canton of Cóbano (CNE, 2013) indicate that the AP is not located in any flood area or zone of slope instability.” This is supported by field observations, during which no evidence of slope instability or erosion problems was observed, and confirmed by the soil study incorporated into the environmental assessment.

The project is not being developed in the slope area but rather on a terrace; for this reason, the summary of the corresponding protocol refers to a 5% gradient, which is the gradient of the terrace on which the project is being developed.

The event that caused material to be washed away throughout the area from projects located in the zone consisted of rainfall events that occurred in March, during the dry season, a fact that must be regarded as an extraordinary event that could not have been predicted.

Therefore, based on the site visits conducted by the consulting team, there was no on-site evidence of potential slope-instability or slope-erosion problems; moreover, according to the official databases of the Comisión Nacional de Emergencias, there are no records of events of this kind. The events resulted from extraordinary episodes of intense rainfall affecting the entire national territory.

CONSIDERATION 12—REGARDING THE ENVIRONMENTAL MANAGER’S NOTES AND REPORTS ON NATURAL HAZARDS FACING THE PROJECT, AS REPORTED IN ENVIRONMENTAL MANAGEMENT REPORTS AND ENTRIES IN THE PROJECT’S ENVIRONMENTAL LOGBOOK (BITÁCORA AMBIENTAL) Response—ENVIRONMENTAL PLANNING AND DESIGN. On February 21, 2023, it was recommended that the slope (talud) facing the public road at the Residencia Lati project be worked on as early as possible to ensure erosion control during the rainy season. The recommendation was reported and recorded in the Environmental Logbook (Bitácora Ambiental) for the Residencia Lati Project. In response to the recommendation, installation of geotextile on the slope facing the public road at the Residencia Lati project began on March 22, 2022, for the purpose of controlling erosion of the slope’s soil, a fact mentioned in Environmental Oversight Report (Informe de Regencia Ambiental) 1. The earthworks (movimiento de tierra) for the remainder of the project had been completed by October 2022, and the soil had already been compacted.

The project has implemented the mitigation measures (medidas de mitigación) specified in the project’s environmental assessment (evaluación ambiental), as required by the project’s circumstances; therefore, every impact generated during construction of the project has been properly managed and mitigated.

On January 19, 2023, during the oversight visit by Planificación y Diseño Ambiental DLS, the technical management of the Residencias Lati project raised an alert concerning earthworks carried out on neighboring properties during the holiday period (24 dic- 2 ene). Those earthworks were not reported in the reports because the activity had no direct effect on the AP. Because of their magnitude, they were visually monitored during the oversight visits and were included in the logbook entry dated March 22, 2023.

(…)

SEVENTH: After analyzing the complaint, evidence in defense, and case file, this department determines as follows:

Analysis of Allegation 1. Indeed, given the existence of forest, the environmental requirements should, at a minimum, have been made more stringent by requiring the developer to submit the most rigorous environmental impact assessment (valoración de impacto ambiental), but this did not occur, and this therefore warrants granting our request for revocation of the environmental permit (licencia ambiental).

Conclusion: The Residencias Lati project obtained Environmental Feasibility (Viabilidad) through Resolution No.551-2022-Nombre02, and as part of the clarifying documents submitted at that time, a forestry certification (Certificación forestal) was provided by engineer Pablo Castillo Baldares, Forestry Manager (Regente Forestal), regular member number 5696 of the Colegio de Ingenieros Agrónomos, clarifying the following, which I quote verbatim:

“1. According to the Fonafifo 2000 forest-cover map, the property is located in an area with forest cover (cobertura de Bosque).

2.During the field visit, it was found that the portion of the property with the steepest slope consists of young natural regeneration (regeneración natural). The infrastructure works to be carried out are located in areas without trees, except for 4 trees of the species known as guácimo (guazuma ulmifolia).

3.No bodies of water were identified.

4.Attached:

a. Map 1. General Map, Survey Plan 6-2248092-2020, superimposed on a Rectified Aerial Photograph.

b. Map 2. General Map, Survey Plan 6-2248092-2020, Fonafifo 2000 layer.

c. Photographic Record.

Accordingly, it is certified that an area of approximately 2200 square meters within the project area does not constitute forest under the definition of forest contained in Article 3 of Ley Forestal 7575. Likewise, there is no evidence of any land-use change (cambio de uso de la tierra) after the year 2000.” Furthermore, the VLA Resolution stated that, if the project required tree cutting (corta de árboles), the permit had to be obtained beforehand from the local subregional office of MINAE/SINAC (Art. 27 of Ley Forestal). According to the submitted permit ACT-OSRC010-2023, the developer requested the tree-cutting permits, which also states that this resolution was prepared by the evaluating official based on field and assessment report ACT-OSRC-456-2022.

It is important to mention that the reports submitted with the complaint, prepared by SINAC under resolution numbers ACT-OSRC-201-2023 and ACTOSRPL-197-2023, cannot be used as references because the following was requested:

“1. Whether the work carried out by the developer under survey plan P-2248092-2020, property number 244707-000, is the location where earthworks, terrace formation (conformación de terrazas), and the opening of roads in a forest area are reported to have been observed, in accordance with forest ecosystem determination ACT-OSRC-197-2023.

2.Whether, based on the field inspections and the survey performed, it can be determined that the changes observed in the forest cover correspond to the project’s buildings and roads under survey plan P-2248092-2020, property number 244707-000.

Technical report ACT-OSRPL-197-2023 dated July 27, 2022, Determination of Forest in Accordance with the Definition in Costa Rica’s Ley Forestal 7575, states on page 3, in the introduction section, that the study covers properties 6-244715-000, 6-244720-000, 6-244718-000, 6-244709-000 and 6-2447708-000, excluding the property on which case file D1-0092-2022-SETENA, Residencias Lati, survey plan P-2248092-2020, property number 244707-000, is being developed; for this reason, we request that you tell us whether or not this property contains forest and whether it has been logged.” The Área de Conservación Tempisque, in official letter SINAC-ACT-OR-DR-1991-2023 forwarding report ACT-OSRC-274-2023, stated the following in response to the inquiry made through official letters SETENA-DT-ASA-1883-2023 and SETENA-DT-ASA-2140-2023:

“1) The work carried out by the developer under survey plan P-2248092-2020, property number 244707-000, forms part of the complaint concerning land-use change (cambio de uso del suelo) corresponding to case 23-000028-0611-PE.

  • 2)Technical report ACT-OSRPL-197-2023 excludes the property on which case file D1-0092-2022- SETENA, Residencias Lati, survey plan P2248092-2020, property number 244707-000, is being developed, considering that, when the forest expert assessment (pericia de bosque) was prepared, the preexisting cover at the specified site had already been altered and partially removed; therefore, it was not feasible to use that area as a control site for the study.
  • 3)Article 295 of the Code of Criminal Procedure provides, under Confidentiality of Proceedings: ‘The preparatory proceedings shall not be public with respect to third parties. The proceedings may be examined only by the parties, either directly or through their representatives. Attorneys claiming a legitimate interest shall be informed by the Public Prosecutor’s Office of the matter under investigation and of any accused or detained persons, so that they may decide whether to participate in the case. The parties, the officials participating in the investigation, and any other persons who, for any reason, become aware of the proceedings conducted shall be required to maintain confidentiality. Failure to comply with this obligation shall be deemed serious misconduct.’ Because this is a case under investigation and action is being taken under the functional direction of the Cóbano prosecutor’s office, this official is acting in compliance with Article 295 of the Code of Criminal Procedure.

Por tanto, you are hereby informed that the reported facts form part of an open court case, which has been handled by the Cóbano subregional office and cannot be disclosed.” Por tanto, the studies conducted by SINAC cannot be binding because they do not include the property on which the Residencias Lati project, Administrative Case File D1-0092-2022-SETENA, is being developed; as they indicate that it forms part of an open court case, it cannot be disclosed.

Based on all the criteria set forth above, this Secretariat determines that the reported allegation is rejected.

Analysis of Allegation 2. Moreover, as stated by the municipality, thousands of cubic meters of soil (10.000 mil or more) extracted from the property were even detected, which to date have not been assessed by SETENA; this entails circumstances that unquestionably jeopardize the ecosystem, soil resources, biodiversity and, of course, the environmental permit, and we therefore request its revocation due to such serious breaches.

Conclusion: The form submitted during the Environmental Impact Assessment (Evaluación de Impacto Ambiental) process includes the following under Impact on Soil:

Does your AOP contemplate earthworks?

Yes, earthworks involving the hauling of volumes of up to 10.000 m3 outside the AP are contemplated.

State the principal environmental measures that would be implemented to prevent, mitigate, correct, or compensate for the environmental impact that would be generated. You must state whether the environmental measures will be implemented during construction or during operation of the AOP:

Earthworks totaling 2055,74 m3 and fill (relleno) totaling 455,08 m3 will be carried out; these earthworks will be performed properly, and the material removed from the AOP will be handled by an authorized management service, which will dispose of the material properly. In addition, health and (sic) hygiene measures will be taken regarding the equipment used to remove the material from the AOP.

Based on the criterion set forth above, this Secretariat determines that the reported allegation is rejected.

Analysis of Allegation 3. Finally, we were unable to find in the Nombre02 case file an assignment of environmental feasibility (cesión de la viabilidad ambiental) from the original developer to the current developer, a matter that further contributes to another irregularity, and we therefore request that it be so declared.

Conclusion: The current developer is MAGNA PACIFIC SOCIEDAD DE RESPONSABILIDAD LIMITADA, corporate identification number CED05, which applied for and was granted the VLA in Resolution Nº 551-2022-SETENA.

Based on the criterion set forth above, this Secretariat determines that the reported allegation is rejected.

EIGHTH: Article 51 of Decreto Ejecutivo N° 43898 states that Nombre02 must schedule and conduct environmental follow-up and oversight inspections (inspecciones ambientales de seguimiento ambiental y control) of activities, works, or projects, either randomly or whenever warranted by the environmental implications of the activity, work, or project. In conducting the inspections, Nombre02 officials shall verify faithful compliance with the environmental commitments (compromisos ambientales) undertaken and arising from the Environmental Management Table (Cuadro Gestión Ambiental) and the Code of Good Environmental Practices (Código de Buenas Prácticas Ambientales).

POR TANTO

THE PLENARY COMMISSION RESOLVES At Ordinary Session Nº 011 of this Secretariat, held on February 07, 2024, under Article Nº. 016, it resolves:

FIRST: To reject in its entirety the complaint filed with Nombre02 on August 18, 2023, under consecutive filing number 08203-2023, by Mr. Álvaro Sagot Rodríguez, attorney-in-fact for Ms. [Nombre01 001], against the Residencias Lati project, case file D1-0092-2022-SETENA.

SECOND: To notify the municipality of Cóbano so that it may verify the construction permits and proceed within the scope of its authority.

THIRD: To notify Área de Conservación Tempisque for appropriate follow-up within the scope of its authority.

FOURTH: This Resolution may be challenged, within three business days counted from the day following notification, through the ordinary motion for reconsideration (recurso de revocatoria) before SETENA and appeal (recurso de apelación) before the Ministro de Ambiente y Energía, pursuant to Articles 342 et seq. of the Ley General de Administración Pública and Article 87 of the Ley Orgánica del Ambiente.

FIFTH: All documentation submitted to Nombre02 must clearly state the case-file number, resolution number, and complete Nombre01 of the project, as well as an email address for future notifications, or confirm the address appearing in the administrative case file.

SIXTH: The original digitally signed documents (Digital Signature) shall be available to the interested party at http://www.setena.go.cr, where they must be verified by any interested party and any public or private entity.

SEVENTH: The result of the discussion and analysis of the case at issue is: 6 in favor, 0 against and 1 absent; detailed information on that vote may be consulted in the corresponding minutes, which are held by this Secretariat and are publicly accessible.” From this perspective, under the terms developed in the filing instituting the proceedings, the petitioner challenges only actions and omissions attributable to SETENA. I therefore concur with the majority opinion, since that complaint was resolved by that agency during the proceedings in the sub judice matter. Likewise, as a matter of principle, it is not for the Chamber to review whether the license issued complies with environmental legislation, nor whether it was improperly granted or irregularities occurred; if the petitioner seeks to challenge that authorization, or the substance of Nombre02’s decision concerning the application, the petitioner may submit its position to adversarial proceedings through the ordinary channels and introduce such evidence as it deems appropriate. Finally, the appeal for constitutional relief (recurso de amparo) did not attribute any acts or omissions to the Sistema Nacional de Áreas de Conservación; therefore, prima facie, a constitutional review of that issue is unnecessary.

X. DISSENTING OPINION OF JUSTICES SALAZAR ALVARADO AND LARA GAMBOA, DRAFTED BY THE FORMER

With due respect, we dissent from the majority opinion granting the appeal, for the following reasons:

The protection of the right to a healthy and ecologically balanced environment, under the Costa Rican Legal System, is safeguarded not only by Article 50 of the Constitución Política, but also by a series of laws and executive decrees (regulations) currently in force, such as the Ley Orgánica del Ambiente, Ley N° 7554 of 4 de octubre de 1995; the Ley de Biodiversidad, Ley N° 7788 of 30 de abril de 1998; the Ley de Conservación de la Vida Silvestre, Ley N° 7317 of 21 de octubre de 1992; and Decreto Ejecutivo N° 31849 of 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), to cite only a few. In environmental matters, this makes it necessary to distinguish constitutional review (control de constitucionalidad) from legality review (control de legalidad). In this regard, it is the opinion of the undersigned that this Chamber, through an appeal for constitutional relief, should hear a matter alleging a violation of the right to a healthy and ecologically balanced environment only if the Administration has not yet intervened and the violation of that right is manifest and evident, readily ascertainable, of some importance or seriousness, and directly affects a specific person or community.

Otherwise, the matter must be raised and litigated through ordinary legality proceedings (vía de legalidad). Accordingly, mere noncompliance with obligations and duties legally imposed upon the various public administrations in environmental matters is properly heard through administrative or judicial legality proceedings, where the alleged instances of noncompliance or omissions may be reviewed much more comprehensively. It must be borne in mind that an appeal for constitutional relief is a summary, informal, simple, and expedited proceeding; therefore, from the very moment that the Administration intervenes in an environmental matter in the exercise of its powers and conducts a proceeding resulting in the issuance of administrative acts (actos administrativos), review of that matter falls outside the scope of this specialized jurisdiction. Accordingly, review of administrative actions taken in connection with an environmental matter that, for proper assessment, requires plenary proceedings (proceso de conocimiento pleno) is possible only before the ordinary courts, since the design of constitutional-relief proceedings is incompatible with comparing or reviewing technical or legal opinions prepared pursuant to the applicable statutory or regulatory provisions, or with taking additional and more extensive evidence necessary to compare or review the opinions already contained in the administrative record for the case.

The contrary would entail transforming constitutional relief into ordinary plenary proceedings, thereby distorting its nature and frustrating the purposes for which it was designed, causing it to lose its status as an instrument for the effective protection of fundamental rights. Consequently, we consider that when a public entity or body has intervened in various ways, or has issued administrative acts concerning an environmental matter, review and oversight thereof fall within the jurisdiction of the administrative courts (jurisdicción de lo contencioso-administrativo). It is precisely verification of the existence of such administrative intervention that determines that the matter falls within the jurisdiction of legality proceedings. Consequently, this appeal should have been summarily dismissed, since its subject matter is properly litigated, analyzed, and resolved through legality proceedings.

However, since that was not done, the appropriate course is to deny the appeal without ruling on the merits of the issue raised, because it is for the ordinary courts—specifically, the administrative courts—to determine whether the challenged administrative actions and conduct substantively comply with the requirements of the legal system at the statutory level regarding the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment.

XI.Dissenting opinion of Justice Garro Vargas regarding the parts during the processing thereof. Just operative portion of this judgment. Article 52 of the Ley de la Jurisdicción Constitucional (LJC) provides: “If, while the constitutional-relief proceeding is pending, an administrative or judicial decision is issued that reverses, halts, or suspends the challenged action, the appeal shall be granted solely for purposes of compensation and costs, where appropriate.”

My interpretation of that provision is as follows: That “decision” is any valid and effective act by which the competent authority restores the enjoyment of the infringed right. The phrase “where appropriate” refers to costs. Moreover, Article 197 of the Código Procesal Contencioso-Administrativo, cited by the majority pursuant to Article 14 of the LJC, specifically refers only to those: costs.

Certainly, pursuant to Article 48 of the Constitución Política (CP), the essential content of the right to constitutional relief is restorative rather than compensatory; however, Article 51 of the LJC provides: “Every decision granting the appeal shall impose an award, in the abstract, of compensation for the losses and damages caused and payment of the costs of the appeal, with their quantification reserved for enforcement of the judgment.” If the right has been violated and the Chamber so finds, losses and damages may have arisen even if the right has been restored. For that reason, an award of compensation for them in the abstract is appropriate. If this were not done—if such an award were not imposed—then, if losses and damages had in fact arisen, there would be no enforceable basis derived from these proceedings on which to claim them, which could violate Article 41 of the CP. If, despite an award having been imposed in the abstract, no losses or damages occurred, the judge in the ordinary proceedings will so declare, since only that judge is competent to deem their actual existence and extent proven.

I consider that the position adopted by the majority, contrary to its intended purpose, would encourage the Administration to respect rights only when an appeal for constitutional relief has been filed. It remains to be said that Article 52 of the LJC permits the Chamber, if it deems it just, to award costs even when the right has been restored.

For the foregoing reasons, I dissent in part from the operative portion and order an award of compensation for losses and damages, but not costs.

XII.Documentation submitted to the record. The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within a maximum period of thirty business days from notice of this judgment. Otherwise, any such material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in Sesión No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial No. 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in Sesión No. 43-12 held on 3 de mayo del 2012, Article LXXXI.

Por tanto:

The appeal is granted, without any special award of costs, losses, or damages. Justice Castillo Víquez files a separate statement. Justice Cruz Castro files a separate statement. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del diecinueve de abril de dos mil veinticuatro .

Recurso de amparo que se tramita en expediente número 23-030389-0007-CO, interpuesto por [Nombre01 001], mayor, cédula de identidad [CED01], contra la Secretaría Técnica Nacional Ambiental y la Dirección Regional del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación, ambos del Ministerio de Ambiente y Energía.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 11:08 horas del 07 de diciembre de 2023, la recurrente interpone recurso de amparo contra la Secretaría Técnica Nacional Ambiental -SETENA- del Ministerio de Ambiente y Energía -MINAE- y expresa que, desde el 18 de agosto de 2023, planteó una denuncia ambiental ante la autoridad recurrida, misma que se tramita en el expediente No. D1-0092-2022-SETENA, PROYECTO RESIDENCIAS LATI. Detalla que la queja estaba referida a la tala sin permisos de un bosque en Cóbano con el fin de construir varias residencias. Alega que para ello, fue cambiado el uso de suelo en un cerro que era montaña, con lo que, hubo pérdida de la biodiversidad de un corredor biológico y se dieron afectaciones al clima y al paisaje. Esgrime que "los recurridos, para ese cambio de uso del suelo, ni siquiera establecieron en la licencia ambiental la necesidad de exigir una declaratoria de conveniencia nacional, si es que ello fuera procedente, como lo exige la normativa ambiental en la Ley Forestal vinculada por conexidad al ordinal 50 constitucional".Dice que el 18 de agosto se aportó un informe del Sistema Nacional de Áreas de Conservación en el que se detalló la naturaleza de bosque del sitio intervenido y el cambio evidente y manifiesto del mismo, pero nada de ello importó. Alega que “como se aprecia en nuestro escrito de denuncia, se pidió una medida para que se tuviera que aplicar una suspensión del proyecto y nada se ha hecho. 6- Que los recurridos únicamente nos notificaron el 28 de agosto, por medio del oficio Nombre02 DT ASA L699-2023 que se le daba traslado a la empresa constructora, pero de ello, hasta hoy en día, han pasado más de dos meses y nada se resuelve, a pesar de que pedimos medidas cautelares. 7- Que a la fecha seguimos esperando que se revoque la licencia ambiental, que adopten medidas de restauración y protección ambiental en el cerro donde se construye y donde se eliminó el bosque". Con base en los alegatos expuestos, estima que con la actuación acusada, fueron lesionados derechos fundamentales. Pide se declare con lugar el recurso.
  2. 2Mediante resolución de las 10:05 horas del 11 de diciembre de 2023, la Presidencia de la Sala dio curso a este proceso y se le solicitó informe al Secretario General de la Nombre02 sobre los hechos alegados por la recurrente.
  3. 3Informa bajo juramento Ulises Álvarez Acosta, en su condición de Secretario General de la Nombre02 (escrito presentado a las 13:20 horas del 19 de diciembre de 2023) que se procedió a solicitar un informe al Departamento de Auditoría y Seguimiento Ambiental, el cual fue rendido mediante oficio SETENA-DT-ASA-2361-2023, encargado del trámite de la denuncia, en el cual se detalla el seguimiento que se le ha dado a la misma y que se trascribe a continuación:

“PRIMERO: El 30 de marzo del 2022, mediante la resolución No. 551-2022-Nombre02 se otorgó la Viabilidad Ambiental al expediente D1-0092-2022-SETENA, proyecto Residencias Lati, con las siguientes características:

“3 casas de habitación de 1 y 2 niveles que suman 1695 m2 en total, tienen accesos, piscina, áreas verdes y parqueo. Donde se van a utilizar materiales como Concreto, madera, vidrio, estructura metálica, cerámica, entre otros. En la etapa constructiva, primero el movimiento y limpieza de proyecto y después la construcción. Y en la etapa operativa, es la operación de las residencias. La cobertura corresponde a un 33,60% del total del plano y el 66,40% restante se mantendrá como zona verde. Se contempla movimientos de tierra con acarreo fuera del AP de volúmenes hasta 10.000 m3. el movimiento de tierra de 2055,74 m3 y un relleno de 455,08 m3, este movimiento se hará de forma adecuada, y el material que salga del AOP se gestionará con una gestión autorizado el cual dispondrá del material de forma adecuada. Además, se tomarán las medidas de salud e higiene en el equipo que saque el material del AOP. Utilizar un sistema de eficiencia probada como FAFA o tanques mejorados. Respetar los retiros de drenajes con estructuras y linderos de la propiedad. No impermeabilizar el área donde se ubicará el tanque séptico”.

SEGUNDO: El día 20 de abril del 2023, ingresó el consecutivo 04083-2023 referente a denuncia ambiental por parte de la señora [Nombre01 001] contra el proyecto de referencia.

TERCERO: El día 26 de abril de 2023, mediante oficio SETENA-DT-ASA-0791-2023 se solicitó al desarrollador del proyecto referirse a la denuncia presentada, en un plazo de 10 días hábiles. Lo anterior en cumplimiento del debido proceso.

CUARTO: El 12 de mayo de 2023, se realizó la visita de campo al área de proyecto por el Departamento de Auditoría y Seguimiento Ambiental, según consta en el acta de inspección ASA-ACT-INS-0053-2022, para el seguimiento de la denuncia.

QUINTO: Las fechas 05 de abril del 2023 y 29 de abril del 2023, 09 de mayo del 2023, mediante los números de caso 17713, 17647, 18135 de la plataforma digital, se presentaron las referencias técnicas por parte del señor Daniel Loría Sims, regente ambiental, en respuesta a la denuncia interpuesta en contra del proyecto, según oficio SETENA-DT-ASA-0791-2023, donde se le dio traslado al desarrollador del proyecto.

SEXTO: El 1 de junio de 2023, mediante resolución No. 0830-2023-Nombre02 se acogió en forma parcial la denuncia presentada ante la Nombre02 el día 20 de abril del 2023, por parte de la denunciante [Nombre01 001], contra el proyecto Residencias Lati. Únicamente se acogió parcialmente el hecho denunciando por el arrastre de materiales hacia la vía pública. Esto por cuanto se ha indicado en la visita de inspección que durante las precipitaciones de marzo aún no estaban instaladas las medidas ambientales para mitigar el arrastre de la tierra que aún quedaba en el sitio producto del movimiento de tierras realizado para la construcción de las dos casas de habitación que actualmente se encuentran en obra gris. Si bien los movimientos de tierra habían finalizado e inclusive se exportó dicha tierra hacia una propiedad vecina, lo cierto es que durante las precipitaciones dicho material residual en el área de proyecto llegó a la vía pública; sin embargo, no ha sido el único que aportó dicho material reportado dado que existe otro proyecto con importantes movimientos de tierra, proyecto que colinda con el expediente de referencia y por eso se acoge parcialmente. En todo lo demás se denegó la denuncia. Además, se ordenó al desarrollador mantener las medidas de mitigación y control para el arrastre de sedimentos.

SETIMO: El día 08 de junio del 2023, ingresó el consecutivo 05732-2023 sobre el recurso de revocatoria contra resolución 0830-2023-SETENA, interpuesta por parte del señor Álvaro Sagot Rodríguez apoderado de la señora [Nombre01 001].

OCTAVO: El 18 de agosto del 2023, ingresaron los consecutivos 08202 y 08203-2023 referente a un aporte de prueba nueva en referencia a la denuncia ambiental por situaciones irregulares en proyecto, interpuesta por parte del señor Álvaro Sagot Rodríguez apoderado de [Nombre01 001].

NOVENO: El 28 de agosto de 2023, mediante oficio SETENA-DT-ASA-1699-2023 se solicitó al desarrollador del proyecto nuevamente referirse a la ampliación de la denuncia presentada el 18 de agosto del 2023, en un plazo de 10 días hábiles, en cumplimiento del debido proceso.

DÉCIMO: El día 30 de agosto de 2023, mediante resolución No. 1257-2023-Nombre02 se declaró Sin Lugar el recurso de revocatoria contra la de la resolución 0830-2023- Nombre02 del 1 de junio del 2023, quedando incólume la misma.

DÉCIMO PRIMERO: El 13 de setiembre del 2023, ingresó el consecutivo 09099-2023 referente a la respuesta de las pruebas de descargo solicitado mediante oficio SETENA-DT-ASA-1699-2023, en el cual se le dio audiencia al desarrollador para referirse a la ampliación de la denuncia.

DÉCIMO SEGUNDO: El día 19 de setiembre de 2023, una vez analizada la respuesta dada por el desarrollador, mediante oficio SETENA-DT-ASA-1883-2023 se solicitó al Área de Conservación Tempisque, Sistema Nacional de Áreas de Conservación, criterio técnico para proceder con la atención de la denuncia, como prueba para mejor resolver.

DÉCIMO TERCERO: El 9 de noviembre del 2023, mediante oficio SETENA-DT-ASA-2140-2023 se realizó al Área de Conservación Tempisque, Sistema Nacional de Áreas de Conservación, recordatorio de solicitud de criterio técnico, a efectos de poder resolver la denuncia planteada.

DÉCIMO CUARTO: El 18 de diciembre del 2023, se recibió la respuesta por parte del SINAC, bajo el oficio SINAC-ACT-OR-DR-1991-2023 con traslado de informe ACT-OSRC-274-2023, en respuesta a la consulta realizada mediante los oficios 1883-2023 y SETENA-DT-ASA-2140-2023”.

Conclusión. De acuerdo a los antecedentes expuestos en este oficio, se demuestra que la Nombre02 ha realizado los actos necesarios en tiempo y forma para el debido seguimiento de la denuncia interpuesta por la señora [Nombre01 001], representada por el señor Álvaro Sagot Rodríguez, y que a la fecha de la notificación del presente recurso de amparo, no se había resuelto en espera de la respuesta por parte de Área de Conservación Tempisque, Sistema Nacional de Áreas de Conservación. En esta instancia se enviaron los oficios SETENA-DT-ASA-1883-2023 del día 19 de setiembre de 2023 y notificado el día 02 de octubre de 2023 y como recordatorio el oficio SETENA-DT-ASA-2140-2023 del día 09 de noviembre de 2023 y notificado el día 10 de noviembre de 2023. Por otro lado, esa Secretaría recibió el día lunes 18 de diciembre de 2023 la respuesta por parte del SINAC, bajo el oficio SINAC-ACT-OR-DR-1991-2023 con traslado de informe ACT-OSRC-274-2023, en respuesta a la consulta realizadas mediante los oficios SETENA-DT-ASA-1883-2023 y SETENA-DT-ASA-2140-2023, por lo que se procederá al análisis de la información emitida por el SINAC, para resolver y dar respuesta de la denuncia interpuesta por la señora [Nombre01 001].

La respuesta recibida el día lunes 18 de diciembre del 2023, por parte del Área de Conservación Tempisque es indispensable para proceder con la atención de los alegatos expuestos de la denuncia interpuesta, especialmente los descritos a continuación: 1. Si las labores realizadas por el desarrollador bajo el plano P-2248092-2020, número de finca 244707-000, es donde indican que se observa movimientos de tierra, conformación de terrazas y apertura de caminos en área de bosque de conformidad con la determinación de ecosistema de bosque ACT-OSRC-197-2023. 2. Si a partir de las inspecciones de campo con el levantamiento realizado, pueden determinar que los cambios observados en la cobertura forestal corresponden a las construcciones y caminos del proyecto bajo el plano P-2248092-2020, número de finca 244707-000. Solicita declarar sin lugar el recurso.

  1. 4Mediante resolución de las 16:55 horas del 26 de febrero de 2024, la Magistrada Instructora amplió el recurso contra el Director de la Oficina Regional del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación.
  2. 5Mediante resolución de las 17:17 horas del 26 de febrero de 2024, como prueba para mejor resolver, la Magistrada Instructora a Ulises Álvarez Acosta, en su condición de Secretario General de la Nombre02 o quien ocupe ese cargo, que informe a esta Sala lo siguiente: 1) La fecha en que se resolvió la denuncia ambiental presentada por la recurrente. 2) La fecha en que se le notificó a la recurrente lo resuelto.
  3. 6Informa bajo juramento Nelson Marín Mora, en su condición de Director Regional del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía (escrito presentado a las 10:26 horas del 05 de marzo de 2024) en los siguientes términos:

“PRIMERO: Se recibió el Oficio SETENA-DT-ASA-1883-2023 el día 02 de octubre de 2023 Mediante el oficio SETENA-DT-ASA-1883-2023, la Nombre02 indica y solicita lo siguiente:

“El informe ACT-OSRC-201-2023 del 04 de agosto del 2023 indica en el cuadro 1. La información de número de plano y propietarios de las fincas investigadas En la página 7 de este informe indican “que es un caso muy grande y complejo, dado que se trata de una finca madre que recientemente se segregó en varias fincas, por lo que es necesario hacer el montaje de los planos de cada una de las propiedades a fin de definir en cuales fincas se dan cada uno de los hechos evidenciados”.

Como parte de la información citada en el párrafo anterior, al indicar que el informe técnico, se ajusta para los 9 planos del cuadro 1 y al no determinar puntualmente qué corresponde a la propiedad donde se desarrolla el expediente D1-0092-2022-SETENA, Residencias Lati, requerimos y con fundamento en el principio de coordinación interinstitucional solicitamos a SINAC que indique a esta Secretaría lo siguiente:

1. Si las labores realizadas por el desarrollador bajo el plano P-2248092-2020, número de finca 244707-000, es donde indican que se observa movimientos de tierra, conformación de terrazas y apertura de caminos en área de bosque de conformidad con la determinación de ecosistema de bosque ACT-OSRC-197-2023.

2. Si a partir de las inspecciones de campo con el levantamiento realizado, pueden determinar que los cambios observados en la cobertura forestal corresponden a las construcciones y caminos del proyecto bajo el plano P-2248092-2020, número de finca 244707-000.

El informe técnico ACT-OSRPL-197-2023 del 27 de julio del 2022, Determinación de bosque acorde a la definición de Ley Forestal 7575 de Costa Rica, en la página 3, apartado introducción indica que el estudio comprende las fincas 6-244715-000, 6-244720-000, 6- 244718-000, 6-244709-000 y 6-2447708-000, dejando por fuera la finca donde se desarrolla el expediente D1-0092-2022-SETENA, Residencias Lati, plano P-2248092-2020, número de finca 244707-000, por esta razón precisamos nos indiquen si en esta propiedad hay o no bosque y tala del mismo.”.

SEGUNDO: El día 26 de setiembre de 2023, en seguimiento a la causa judicial 23-000028- 0611-PE, donde figura como posible imputado el desarrollador bajo el plano P-2248092- 2020, número de finca 244707-000, se realiza una pericia de la delimitación de las obras y afectación del bosque en cada una de las fincas investigadas en dicha causa.

TERCERO: Entre el 26 de setiembre de 2023 y el 23 de noviembre se termina de analizar la información recabada y se emite el oficio ACT-OSRPL-641-2023 a la Licda. Silvia Solís Dávila, Fiscala Ambiental, Fiscalía Adjunta Agrario Ambiental. Cabe mencionar que, por necesidad institucional por falta de personal, el funcionario a cargo de la investigación, asume entre otras cosas, a su vez dos recargos de jefaturas en las oficinas subregionales Paquera-Lepanto y Cóbano, lo que condiciona los tiempos de respuesta de atención debido al alto volumen de trabajo de recargo.

CUARTO: El 05 de diciembre de 2023, se emite el oficio ACT-OSRC-274-2023, donde se le da respuesta al Oficio SETENA-DT-ASA-1883-2023 y se indica lo siguiente:

  • 1)Las labores realizadas por el desarrollador bajo el plano P-2248092-2020, número de finca 244707-000, forman parte de la denuncia por cambio de uso del suelo correspondiente a la causa 23-000028-0611-PE.
  • 2)El informe técnico ACT-OSRPL-197-2023 deja por fuera la finca donde se desarrolla el expediente D1-0092-2022-SETENA, Residencias Lati, plano P-2248092-2020, número de finca Dirección01, considerando que, al momento de la elaboración de la pericia de bosque, la cobertura prexistente en el sitio indicado había sido alterada y removida parcialmente, por tanto, no era viable utilizar esa área como testigo para el estudio.
  • 3)El código Procesal Penal dispone en su artículo 295, Privacidad de las actuaciones: “El procedimiento preparatorio no será público para terceros. Las actuaciones sólo podrán ser examinadas por las partes, directamente o por medio de sus representantes. Los abogados que invoquen un interés legítimo serán informados por el Ministerio Público sobre el hecho que se investiga y sobre los imputados o detenidos que existan, con el fin de que decidan si aceptan participar en el caso. Las partes, los funcionarios que participen de la investigación y las demás personas que, por cualquier motivo, tengan conocimiento de las actuaciones cumplidas, tendrán la obligación de guardar secreto. El incumplimiento de esta obligación será considerado falta grave.” Al ser un caso en investigación y que se está actuando bajo dirección funcional de la fiscalía de Cóbano este funcionario actúa en apego al código procesal penal en su artículo 295.

Por tanto, se les comunica que los hechos denunciados forman parte de una causa judicial abierta, la cual ha sido atendida por la oficina subregional de Cóbano y no puede ser divulgada”.

  1. 7Informa bajo juramento Ulises Álvarez Acosta, en su condición de Secretario General de la Nombre02 (escrito presentado a las 13:47 horas del 21 de marzo de 2024) que la denuncia presentada por la recurrente fue resuelta por resolución No. 0186-2024-Nombre02 de las 10:45 horas del 07 de febrero de 2024. Según comprobante de notificación, la misma fue notificada a la recurrente el día 7 de febrero de 2024, a las 11:36 horas, al correo electrónico: ...01, lugar indicado en la denuncia. Solicita declarar sin lugar el recurso.
  2. 8En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I.Sobre el conocimiento de este caso por lesión al artículo 41 de la Constitución Política. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia No. 2008-002545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la Administración Pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues, se está ante una denuncia ambiental que, presuntamente, no ha sido resuelta dentro de un plazo razonable. Aclarado el punto, se entra a resolver, la situación concreta planteada en este amparo.

II.Objeto del recurso. La recurrente alega que el 18 de agosto de 2023 planteó una denuncia ambiental ante la SETENA, la cual se tramita en el expediente No. D1-0092-2022-SETENA, PROYECTO RESIDENCIAS LATI. Detalla que la queja está referida a la tala sin permisos de un bosque en Cóbano con el fin de construir varias residencias. Dice que se pidió una medida para que se tuviera que aplicar una suspensión del proyecto y nada se ha hecho. Únicamente les notificaron el 28 de agosto, por medio del oficio Nombre02 DT ASA L699-2023, que se le daba traslado a la empresa constructora, pero de ello han pasado más de dos meses y nada se resuelve, a pesar de que se pidieron medidas cautelares. Sigue esperando que se revoque la licencia ambiental, así como que adopten medidas de restauración y protección ambiental en el cerro donde se construye y se eliminó el bosque.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque los recurridos hayan omitido referirse a ellos según lo prevenido en el auto inicial:

  • 1)El 30 de marzo de 2022, mediante la resolución No. 551-2022-SETENA, Nombre02 otorgó la Viabilidad Ambiental al expediente D1-0092-2022-SETENA, proyecto Residencias Lati (véase primer informe del Secretario General de la SETENA).
  • 2)El 20 de abril de 2023, ingresó el consecutivo 04083-2023 referente a denuncia ambiental por parte de la señora [Nombre01 001] contra el proyecto de referencia (véase primer informe del Secretario General de la SETENA).
  • 3)El 26 de abril de 2023, mediante oficio SETENA-DT-ASA-0791-2023, se solicitó al desarrollador del proyecto referirse a la denuncia presentada en un plazo de 10 días hábiles (véase primer informe del Secretario General de la SETENA).
  • 4)El 12 de mayo de 2023, se realizó la visita de campo al área de proyecto por el Departamento de Auditoría y Seguimiento Ambiental, según consta en el acta de inspección ASA-ACT-INS-0053-2022, para el seguimiento de la denuncia (véase primer informe del Secretario General de la SETENA).
  • 5)En fechas 05 de abril de 2023, 29 de abril de 2023 y 09 de mayo de 2023, mediante los números de caso 17713, 17647, 18135 de la plataforma digital, se presentaron las referencias técnicas por parte del señor Daniel Loría Sims, regente ambiental, en respuesta a la denuncia interpuesta en contra del proyecto, según oficio SETENA-DT-ASA-0791-2023, donde se le dio traslado al desarrollador del proyecto (véase primer informe del Secretario General de la SETENA).
  • 6)El 1° de junio de 2023, mediante resolución No. 0830-2023-SETENA, se acogió en forma parcial la denuncia presentada ante la Nombre02 el 20 de abril de 2023, por parte de la denunciante [Nombre01 001], contra el proyecto Residencias Lati. Únicamente se acogió parcialmente el hecho denunciando por el arrastre de materiales hacia la vía pública. En todo lo demás se denegó la denuncia. Además, se ordenó al desarrollador mantener las medidas de mitigación y control para el arrastre de sedimentos (véase primer informe del Secretario General de la SETENA).
  • 7)El 08 de junio de 2023, ingresó el consecutivo 05732-2023 sobre el recurso de revocatoria contra resolución la 0830-2023-SETENA, interpuesta por parte del señor Álvaro Sagot Rodríguez, apoderado de la señora [Nombre01 001] (véase primer informe del Secretario General de la SETENA).
  • 8)El 18 de agosto de 2023, ingresaron los consecutivos 08202 y 08203-2023 referente a un aporte de prueba nueva en referencia a la denuncia ambiental por situaciones irregulares en proyecto, interpuesta por parte del señor Álvaro Sagot Rodríguez, apoderado de [Nombre01 001] (véase primer informe del Secretario General de la SETENA).
  • 9)El 28 de agosto de 2023, mediante oficio SETENA-DT-ASA-1699-2023, se solicitó al desarrollador del proyecto nuevamente referirse a la ampliación de la denuncia presentada el 18 de agosto de 2023, en un plazo de 10 días hábiles, en cumplimiento del debido proceso (véase primer informe del Secretario General de la SETENA).
  • 10)El 30 de agosto de 2023, mediante resolución No. 1257-2023-SETENA, se declaró sin lugar el recurso de revocatoria interpuesto contra la resolución 0830-2023- Nombre02 del 1° de junio del 2023, quedando incólume la misma (véase primer informe del Secretario General de la SETENA).
  • 11)El 13 de setiembre de 2023, ingresó el consecutivo 09099-2023 referente a la respuesta de las pruebas de descargo solicitado mediante oficio SETENA-DT-ASA-1699-2023, en el cual se le dio audiencia al desarrollador para referirse a la ampliación de la denuncia (véase primer informe del Secretario General de la SETENA).
  • 12)El 19 de setiembre de 2023, una vez analizada la respuesta dada por el desarrollador, mediante oficio SETENA-DT-ASA-1883-2023 se solicitó como prueba para mejor resolver al Área de Conservación Tempisque, Sistema Nacional de Áreas de Conservación, criterio técnico para proceder con la atención de la denuncia (véase primer informe del Secretario General de la SETENA).
  • 13)El 02 de octubre de 2023, se recibió en el Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación el oficio SETENA-DT-ASA-1883-2023, donde Nombre02 solicita criterio técnico (véase informe del Director Regional del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación).
  • 14)El 26 de setiembre de 2023, en seguimiento a la causa judicial 23-000028-0611-PE, donde figura como posible imputado el desarrollador bajo el plano P-2248092-2020, número de finca 244707-000, el Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación realiza una pericia de la delimitación de las obras y afectación del bosque en cada una de las fincas investigadas en dicha causa (véase informe del Director Regional del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación).
  • 15)Entre el 26 de setiembre de 2023 y el 23 de noviembre de 2023, el Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación termina de analizar la información recabada y se emite el oficio ACT-OSRPL-641-2023 a la Licda. Silvia Solís Dávila, Fiscala Ambiental, Fiscalía Adjunta Agrario Ambiental. Cabe mencionar que, por necesidad institucional por falta de personal, el funcionario a cargo de la investigación, asume entre otras cosas, a su vez dos recargos de jefaturas en las oficinas subregionales Paquera-Lepanto y Cóbano, lo que condiciona los tiempos de respuesta de atención debido al alto volumen de trabajo de recargo (véase informe del Director Regional del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación).
  • 16)El 09 de noviembre de 2023, mediante oficio SETENA-DT-ASA-2140-2023 se realizó por parte de la Nombre02 al Área de Conservación Tempisque, Sistema Nacional de Áreas de Conservación, recordatorio de solicitud de criterio técnico, a efectos de poder resolver la denuncia planteada (véase primer informe del Secretario General de la SETENA).
  • 17)El 05 de diciembre de 2023, se emite el oficio ACT-OSRC-274-2023, donde el Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación da respuesta al oficio SETENA-DT-ASA-1883-2023 (véase informe del Director Regional del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación).
  • 18)El 18 de diciembre de 2023, se recibió la respuesta por parte del SINAC, bajo el oficio SINAC-ACT-OR-DR-1991-2023 con traslado de informe ACT-OSRC-274-2023, en respuesta a la consulta realizada mediante los oficios SETENA-DT-ASA-1883-2023 y SETENA-DT-ASA-2140-2023 (véanse primer informe del Secretario General de la Nombre02 y prueba documental aportada).
  • 19)Por resolución No. 0186-2024-Nombre02 de las 10:45 horas del 07 de febrero de 2024, la Nombre02 resolvió la denuncia presentada por la recurrente (véanse segundo informe del Secretario General de la Nombre02 y prueba documental aportada).
  • 20)El 07 de febrero de 2024, a las 11:36 horas, mediante correo electrónico, se le notificó a la recurrente la resolución No. 0186-2024-Nombre02 (véanse segundo informe del Secretario General de la Nombre02 y prueba documental aportada).

IV.Sobre el principio de justicia pronta y cumplida. La Administración, a la luz del artículo 41 constitucional, tiene la obligación de garantizarle a la ciudadanía el cumplimiento de la justicia pronta y cumplida, sin denegación, lo que implica, en el ámbito de la justicia administrativa, su obligación de decidir con diligencia y celeridad los reclamos planteados por los administrados, de tal manera que su resolución sea congruente con los extremos alegados, así como de comunicarles a los interesados lo dispuesto, todo ello dentro de un plazo razonable. En este sentido, el carácter "razonable" de la duración de la actividad administrativa se determina casuísticamente con base en diversos elementos, tales como la complejidad técnica del asunto administrativo, la amplitud de la prueba por evacuar o el grado de afectación a la persona o al ambiente del acto impugnado, de lo cual se infiere que no existe un derecho estricto a la constitucionalización de los plazos, sino más bien un derecho a que se aplique el control de constitucionalidad sobre aquellas actuaciones de la Administración, en las cuales no existan motivos suficientes para justificar el tiempo demorado en la solución de algún tipo de gestión administrativa.

V.Sobre el caso concreto. En el presente asunto, se colige de los autos que la inconformidad de la recurrente se circunscribe a la demora en resolver por parte de la Nombre02 la ampliación a la denuncia inicialmente presentada y que tiene relación con el proyecto Residencias Lati tramitado en el expediente D1-0092-2022-SETENA, al cual, mediante la resolución No. 551-2022-Nombre02 del 30 de marzo de 2022, otorgó viabilidad ambiental. Se comprueba que las características de ese proyecto son las siguientes: “3 casas de habitación de 1 y 2 niveles que suman 1695 m2 en total, tienen accesos, piscina, áreas verdes y parqueo. Donde se van a utilizar materiales como Concreto, madera, vidrio, estructura metálica, cerámica, entre otros. En la etapa constructiva, primero el movimiento y limpieza de proyecto y después la construcción. Y en la etapa operativa, es la operación de las residencias. La cobertura corresponde a un 33,60% del total del plano y el 66,40% restante se mantendrá como zona verde.

Se contempla movimientos de tierra con acarreo fuera del AP de volúmenes hasta 10.000 m3. el movimiento de tierra de 2055,74 m3 y un relleno de 455,08 m3, este movimiento se hará de forma adecuada, y el material que salga del AOP se gestionará con una gestión autorizado el cual dispondrá del material de forma adecuada. Además, se tomarán las medidas de salud e higiene en el equipo que saque el material del AOP. Utilizar un sistema de eficiencia probada como FAFA o tanques mejorados. Respetar los retiros de drenajes con estructuras y linderos de la propiedad. No impermeabilizar el área donde se ubicará el tanque séptico”.

Se constata que, primeramente, el 20 de abril de 2023 ingresó a la Nombre02 el consecutivo 04083-2023 referente a denuncia ambiental por parte de la señora [Nombre01 001] contra el proyecto antes descrito. En atención a esa gestión, el 26 de abril de 2023, mediante oficio SETENA-DT-ASA-0791-2023, se solicitó al desarrollador del proyecto referirse a la denuncia presentada en un plazo de 10 días hábiles. Además, el 12 de mayo se realizó la visita de campo al área de proyecto por el Departamento de Auditoría y Seguimiento Ambiental, según consta en el acta de inspección ASA-ACT-INS-0053-2022, para el seguimiento de la denuncia. Asimismo, en fechas 05 de abril de 2023, 29 de abril de 2023 y 09 de mayo de 2023, mediante los números de caso 17713, 17647, 18135 de la plataforma digital, se presentaron las referencias técnicas por parte del señor Daniel Loría Sims, regente ambiental, en respuesta a la denuncia interpuesta en contra del proyecto, según oficio SETENA-DT-ASA-0791-2023, donde se le dio traslado al desarrollador del proyecto.

De ahí que el 1° de junio de 2023, mediante resolución No. 0830-2023-SETENA, se acogió en forma parcial la citada denuncia. Únicamente se acogió parcialmente el hecho denunciando por el arrastre de materiales hacia la vía pública. Ello con el siguiente sustento: “se ha indicado en la visita de inspección que durante las precipitaciones de marzo aún no estaban instaladas las medidas ambientales para mitigar el arrastre de la tierra que aún quedaba en el sitio producto del movimiento de tierras realizado para la construcción de las dos casas de habitación que actualmente se encuentran en obra gris. Si bien los movimientos de tierra habían finalizado e inclusive se exportó dicha tierra hacia una propiedad vecina, lo cierto es que durante las precipitaciones dicho material residual en el área de proyecto llegó a la vía pública; sin embargo, no ha sido el único que aportó dicho material reportado dado que existe otro proyecto con importantes movimientos de tierra, proyecto que colinda con el expediente de referencia y por eso se acoge parcialmente”.

En todo lo demás se denegó la denuncia. Además, se ordenó al desarrollador mantener las medidas de mitigación y control para el arrastre de sedimentos. Se comprueba que el 08 de junio de 2023 ingresó recurso de revocatoria contra la anterior resolución interpuesto por parte del señor Álvaro Sagot Rodríguez, apoderado de la recurrente. Objeción que el 30 de agosto de 2023, mediante resolución No. 1257-2023-SETENA, se declaró sin lugar.

En lo que tiene relación con lo planteado en este amparo, se acredita que el 18 de agosto de 2023 ingresaron a la Nombre02 los consecutivos 08202 y 08203-2023 referente a un aporte de prueba nueva en referencia a la denuncia ambiental por situaciones irregulares en el citado proyecto, interpuestos por parte del señor Álvaro Sagot Rodríguez, apoderado de la recurrente. Por ello, el 28 de agosto, mediante oficio SETENA-DT-ASA-1699-2023, se solicitó al desarrollador del proyecto referirse a la ampliación de la denuncia en un plazo de 10 días hábiles, en cumplimiento del debido proceso. Se tiene que el 13 de setiembre se recibió la respuesta correspondiente. Aunque el 19 de setiembre, una vez analizada esa respuesta dada por el desarrollador, mediante oficio SETENA-DT-ASA-1883-2023 se solicitó como prueba para mejor resolver al Área de Conservación Tempisque, Sistema Nacional de Áreas de Conservación, criterio técnico para proceder con la atención de la denuncia.

Esa misiva la recibió dicha Área el 02 de octubre, donde Nombre02 señala y solicita lo siguiente: “El informe ACT-OSRC-201-2023 del 04 de agosto del 2023 indica en el cuadro 1. La información de número de plano y propietarios de las fincas investigadas En la página 7 de este informe indican “que es un caso muy grande y complejo, dado que se trata de una finca madre que recientemente se segregó en varias fincas, por lo que es necesario hacer el montaje de los planos de cada una de las propiedades a fin de definir en cuales fincas se dan cada uno de los hechos evidenciados”. Como parte de la información citada en el párrafo anterior, al indicar que el informe técnico, se ajusta para los 9 planos del cuadro 1 y al no determinar puntualmente qué corresponde a la propiedad donde se desarrolla el expediente D1-0092-2022-SETENA, Residencias Lati, requerimos y con fundamento en el principio de coordinación interinstitucional solicitamos a SINAC que indique a esta Secretaría lo siguiente: 1.

Si las labores realizadas por el desarrollador bajo el plano P-2248092-2020, número de finca 244707-000, es donde indican que se observa movimientos de tierra, conformación de terrazas y apertura de caminos en área de bosque de conformidad con la determinación de ecosistema de bosque ACT-OSRC-197-2023. 2. Si a partir de las inspecciones de campo con el levantamiento realizado, pueden determinar que los cambios observados en la cobertura forestal corresponden a las construcciones y caminos del proyecto bajo el plano P-2248092-2020, número de finca 244707-000. El informe técnico ACT-OSRPL-197-2023 del 27 de julio del 2022, Determinación de bosque acorde a la definición de Ley Forestal 7575 de Costa Rica, en la página 3, apartado introducción indica que el estudio comprende las fincas 6-244715-000, 6-244720-000, 6- 244718-000, 6-244709-000 y 6-2447708-000, dejando por fuera la finca donde se desarrolla el expediente D1-0092-2022-SETENA, Residencias Lati, plano P-2248092-2020, número de finca 244707-000, por esta razón precisamos nos indiquen si en esta propiedad hay o no bosque y tala del mismo”.

Se informa que el 26 de setiembre de 2023, en seguimiento a la causa judicial 23-000028-0611-PE, donde figura como posible imputado el desarrollador bajo el plano P-2248092-2020, número de finca 244707-000, el Área de Conservación Tempisque realiza una pericia de la delimitación de las obras y afectación del bosque en cada una de las fincas investigadas en dicha causa. Además, entre el 26 de setiembre de 2023 y el 23 de noviembre de 2023, termina de analizar la información recabada y se emite el oficio ACT-OSRPL-641-2023 a la Licda. Silvia Solís Dávila, Fiscala Ambiental, Fiscalía Adjunta Agrario Ambiental. No obstante, el 05 de diciembre de 2023, se emite el oficio ACT-OSRC-274-2023, donde el Área de Conservación Tempisque da respuesta al oficio SETENA-DT-ASA-1883-2023 y se indica lo siguiente:

  • 1)Las labores realizadas por el desarrollador bajo el plano P-2248092-2020, número de finca 244707-000, forman parte de la denuncia por cambio de uso del suelo correspondiente a la causa 23-000028-0611-PE.
  • 2)El informe técnico ACT-OSRPL-197-2023 deja por fuera la finca donde se desarrolla el expediente D1-0092-2022-SETENA, Residencias Lati, plano P-2248092-2020, número de finca 244707-000, considerando que, al momento de la elaboración de la pericia de bosque, la cobertura prexistente en el sitio indicado había sido alterada y removida parcialmente, por tanto, no era viable utilizar esa área como testigo para el estudio.
  • 3)El código Procesal Penal dispone en su artículo 295, Privacidad de las actuaciones: “El procedimiento preparatorio no será público para terceros. Las actuaciones sólo podrán ser examinadas por las partes, directamente o por medio de sus representantes. Los abogados que invoquen un interés legítimo serán informados por el Ministerio Público sobre el hecho que se investiga y sobre los imputados o detenidos que existan, con el fin de que decidan si aceptan participar en el caso. Las partes, los funcionarios que participen de la investigación y las demás personas que, por cualquier motivo, tengan conocimiento de las actuaciones cumplidas, tendrán la obligación de guardar secreto. El incumplimiento de esta obligación será considerado falta grave.” Al ser un caso en investigación y que se está actuando bajo dirección funcional de la fiscalía de Cóbano este funcionario actúa en apego al código procesal penal en su artículo 295. Por tanto, se les comunica que los hechos denunciados forman parte de una causa judicial abierta, la cual ha sido atendida por la oficina subregional de Cóbano y no puede ser divulgada”. Esa respuesta la recibió la Nombre02 el 18 de diciembre de 2023. De ahí que, finalmente, por resolución No. 0186-2024-Nombre02 de las 10:45 horas del 07 de febrero de 2024, resolvió la denuncia presentada por la recurrente en el siguiente sentido: “PRIMERO: Rechazar en forma total, la denuncia presentadas ante la Nombre02 el día 18 de agosto de 2023, mediante le consecutivo 08203-2023, el señor Álvaro Sagot Rodríguez apoderado de la señora [Nombre01 001], contra el proyecto Residencias Lati con expediente D1-0092-2022-SETENA”. Pronunciamiento que le fue notificado a la recurrente ese mismo día.

De la anterior reseña se comprueba que ambas autoridades recurridas incurrieron en demora en tramitar y atender lo que correspondía a cada una en atención a la ampliación de la denuncia presentada por el apoderado de la recurrente. Si bien la SETENA, inicialmente, fue diligente en su tramitación e incluso solicitó con prontitud criterio técnico a quien estimó correspondía, se retrasó en el dictado de la resolución de fondo. Nótese que se acredita que recibió el referido criterio técnico el 18 de diciembre de 2023, pero emite la resolución No. 0186-2024-SETENA, que rechaza esa ampliación de denuncia, hasta el 07 de febrero pasado. En cuanto al Área de Conservación Tempisque se constata que recibió la solicitud de criterio técnico el 02 de octubre de 2023, pero lo emite más de dos meses después, concretamente el 05 de diciembre. En ese sentido, se reconoce que, por necesidad institucional por falta de personal, el funcionario a cargo de la investigación, asume entre otras cosas, a su vez dos recargos de jefaturas en las oficinas subregionales Paquera-Lepanto y Cóbano, lo que condiciona los tiempos de respuesta de atención debido al alto volumen de trabajo de recargo.

Situación que es entendible, pero no puede ser un justificante en la demora de atender lo solicitado por la Nombre02 y que incidió en el retraso en resolver lo planteado, pues se estaba a la espera del criterio requerido. Ante el escenario descrito, no hay duda que se ha producido la infracción del derecho a una justicia administrativa pronta en perjuicio de la recurrente, pues se constata que no se ha sido diligente en el trámite de la gestión presentada. Esa demora, ha implicado una denegación de justicia administrativa, por lo que se recuerda a la parte recurrida la obligación de la Administración de actuar según los principios de eficacia, eficiencia, simplicidad y celeridad. De ahí la procedencia del reclamo. Sin embargo, en vista de que, con ocasión a la intervención de esta Sala, se resolvió la ampliación de la denuncia y se notificó lo resuelto a la administrada, lo procedente es estimar el recurso, según se dirá a continuación.

VI.Conclusión. De tal forma, al acreditarse la infracción constitucional en los términos dichos, el recurso debe ser declarado con lugar contra ambas autoridades recurridas aunque sin especial condenatoria en costas, daños y perjuicios, pues ya se resolvió la ampliación de la denuncia presentada por el apoderado de la recurrente.

VII.Sobre la condenatoria en costas, daños y perjuicios de conformidad con el artículo 52 de la Ley de la Jurisdicción Constitucional. Bajo una mejor ponderación, la mayoría de la Sala considera que, en el sub examine, de conformidad con lo dispuesto en el párrafo 1° del artículo 52 de la Ley de la Jurisdicción Constitucional (“Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes”), la estimatoria debe serlo sin especial condenatoria en costas, daños y perjuicios, con base en las siguientes consideraciones. Si bien hay un texto expreso en la ley que obliga a que la parte dispositiva del fallo indique que se declara con lugar el recurso, cuando estando en curso del amparo se resuelva el agravio, no menos cierto es que ese mismo párrafo in fine refiere que la estimatoria se dicta “únicamente para efectos de indemnización y de costas, si fueren procedentes”.

Se subraya que la Ley indica “si fueren procedentes”, lo cual significa que la procedencia o improcedencia de la indemnización y costas depende de una valoración, apreciación o ponderación del Tribunal. En casos como este, el contenido de la pretensión de la persona amparada y la conducta de la autoridad recurrida de reconocer aquella, sugieren que los menoscabos, lesiones o alteraciones alegados no están referidos de modo directo a una repercusión en un derecho constitucional de evidente naturaleza patrimonial (como sí ocurriría, por ejemplo, con una afectación al derecho al salario). Para disipar cualquier duda al respecto, es importante destacar lo dispuesto en el artículo 51 de la misma Ley de la Jurisdicción Constitucional, cuando dispone que: “toda resolución que acoja el recurso condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas del recurso, y se reservará su liquidación para la ejecución de sentencia”, donde no se prevé la posibilidad de valorar si procede o no lo concerniente a indemnización y costas.

Los principios del Derecho Constitucional, los del Público y Procesal General o, en su caso, los del Derecho Internacional o Comunitario y, además, por su orden, la Ley General de la Administración Pública y el Código Procesal Contencioso Administrativo y los demás códigos procesales, son fuente supletoria para la aplicación e interpretación de las normas de la Ley de la Jurisdicción Constitucional -cfr. artículo 14-. Para la jurisdicción contencioso-administrativa, el legislador estableció un precepto plenamente aplicable al caso por analogía, en el artículo 197 del Código Procesal Contencioso Administrativo, que responde a la lógica procesal en cualquier materia. En todo caso, la parte afectada del sub lite preserva la posibilidad de acudir, si a bien lo tiene, a un proceso de conocimiento a fin de demostrar que ha sufrido algún tipo de menoscabo. Con base en lo anterior, es criterio de mayoría resolver este recurso sin condenatoria en costas, daños y perjuicios.

VIII.Nota del magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.

A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia No. 2008-002545 de las 08:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

IX. NOTA DEL MAGISTRADO CRUZ CASTRO

En el sub examine, la parte recurrente menciona que el 18 de agosto de 2023 planteó una denuncia ante la Setena, que se tramita en el expediente nro. D1-0092-2022-SETENA, PROYECTO RESIDENCIAS LATI. Detalla que la queja está referida a la tala sin permisos de un bosque en Cóbano con el fin de construir varias residencias. Reclama que tal gestión no ha sido resuelta ni se ha anulado y que Nombre02 no ha protegido los bosques nacionales, lo que lesiona los numerales 50 y 89 constitucionales. Considera que se debe anular la licencia ambiental emitida.

Al respecto, la gestión formulada por la persona amparada el 18 de agosto de 2023 señala:

“PRIMERO: De hecho al existir bosque, se debieron cuando menos extremar las exigencias ambientales al pedir al desarrollador la más rigurosa valoración de impacto ambiental, pero ello no ocurrió y por esto amerita acoger nuestro pedido de revocatoria de la licencia ambiental.

En la resolución de la Comisión Plenaria No. 0830-2023-SETENA, se resolvió la anterior denuncia se señaló que todo se hizo a derecho, que no hacía falta hacer una inspección de previo al otorgamiento de la licencia, aunque la LOA lo obligaba, que no hubo efectos negativos ambientales en los ecosistemas, que no era materia de Nombre02 el valorar el sitio del proyecto para considerar si existía o no un bosque etc.

Pero ahora, mediante la documentación que aportamos cobra sentido todo lo que expusimos y pedimos se tomen las medidas restaurativas y se aplique incluso el principio de irreductibilidad del bosque, en uso del principio de inversión en la carga de la prueba, puesto que la Dirección02, plano catastrado P-2248092-2020 está señalada en la denuncia como parte de lo que es bosque en el cuadro 1 del documento denominado como Informe de inspección sobre posible tala de bosque y cambios de uso en Hermosa de Cóbano. Y es un bosque donde incluso se han hecho caminos de acceso dentro del propio bosque y esto ha contribuido a los daños ambientales que hablamos desde la denuncia inicial.

Es manifiesto que si se hubiese hecho la inspección de rigor que establece la norma de la LOA, se habría detectado lo denunciado y es que esto involucra también a las licencias ambientales que se emitieron para los proyectos ubicados en los alrededores inmediatos que deberán ser analizados por ustedes también para no ser partícipes en daños ambientales.

La determinación de que no existía un bosque en el área del proyecto fue totalmente falsa y la verdad es que nunca existió un decreto de conveniencia nacional, por ello pedimos que se abran los procedimientos administrativos sancionatorios contra los profesionales involucrados y contra los gestores del proyecto. Pedimos que se cancele la licencia ambiental y se ordene hacer una restauración ecosistémica.

El principio de inversión en la carga de la prueba, obliga a tomar acciones inmediatas, suspendiendo la licencia ambiental y así pedimos disponerlo pues sino la propia Nombre02 sería partícipe de daños ambientales.

Por su parte en la misma línea anterior, recordemos que nuestra Ley de la Biodiversidad incluso señala en el numeral 8 de ese cuerpo normativo, que está vinculado al numeral 50 constitucional por conexidad, que la propiedad privada debe cumplir una función ambiental, pero al parecer en este caso se ha omitido valorar lo pertinente del proyecto y por ello tenemos que se ha dado un cambio de uso del suelo que hace que se deba aplicar el principio de irreductibilidad de los bosques, para que las cosas vuelvan a lo que existía anteriormente mediante los procesos restaurativos respectivos.

En la misma tónica expuesta supra, consideramos que la licencia ambiental se confronta el numeral 49 de la Ley de la Biodiversidad, puesto que han descuidado la biodiversidad al permitirse, sin fiscalización, una tala rasa sin criterios, ni valoraciones técnicas, de un sitio que tenía una clara cobertura boscosa y vocación forestal, tal y como consta en las fotografías aportadas por nosotros inicialmente y por lo señalado en el dictamen de bosque del SINAC que se adjunta.

La norma 17 de la Ley Orgánica del Ambiente y la 92 de la Ley de la Biodiversidad, establecen de manera clara la obligación estatal de hacer evaluaciones de impacto ambiental cuando conlleven impactos ambientales a la biodiversidad y si bien acá si existió una, lo cierto es que la misma no abarcó todas las aristas y por ello hubo situaciones que rozan con la legalidad y generan vicios de nulidad absoluta, pues se cambió el uso del suelo forestal, por el residencial, tal y como hemos venido argumentando y para lo señalado NO mediaron valoraciones de los impactos de la pérdida de ecosistemas en un sitio que hoy en día se sabe que es un bosque y lo peor, es que nunca existió, ni siquiera, una inspección de parte de SETENA, violando con ello el deber normativo previsto en el artículo 84 de la Ley Orgánica del Ambiente, tal y como lo dijimos.

Por lo anterior, tenemos vicios en la licencia que están en el contenido y en el motivo del acto habilitador al faltar elementos esenciales que no se borran con el decirse que se creyó en los informes de los consultores, puesto que acá, como dijimos, estamos ante deberes establecidos por la propia Ley Orgánica del Ambiente de forma expresa. Por otra parte, la misma Ley General de la Administración Pública establece en la norma 132:

"Artículo 132.- l. El contenido deberá de ser lícito, posible, claro y preciso y abarcar todas las cuestiones de hecho y derecho surgidas del motivo, aunque no hayan sido debatidas por las partes interesadas. 2. Deberá ser además, proporcionado al fin legal y correspondiente al motivo, cuando ambos se hallen regulados... " Y es que al haberse omitido la inspección de rigor, es de decir, la inspección de ley, es manifiesto que NO se abarcaron estudios donde se ponderaran evidentemente todas las situaciones de hecho y derecho y esa falta de valoración integral de obligaciones legales pudieron llevar, a que, por medio de la licencia, se obtuviera ilegalmente a una autorización que cambió el uso del suelo en el área del proyecto.

En la licencia se dijo, a modo de justificación para no realizar la inspección:

"Habiendo revisado la información contenida en el expediente administrativo Dl-00922022-SETENA, y analizado la ubicación del proyecto según informe emitido por el área de Geografía, cumpliendo de esta manera con lo establecido en el Decreto Ejecutivo NO 31849MINAE-S-MOPT-MAG-MEIC y sus modificaciones, el Departamento de Evaluación Ambiental determinó no realizar la inspección de campo. Como elementos adicionales que sustentan esta decisión se tienen: l. La naturaleza del proyecto. 2. La congruencia del proyecto propuesto con el entorno. 3. La significancia de impacto ambiental obtenida en el Documento de Evaluación Ambiental Dl. 4. El contar con un registro fotográfico del área de proyecto. 5. Las conclusiones de los estudios adjuntos al instrumento de evaluación, no determinan indicios particulares que deban ser profundizados y corroborados con la inspección de campo" Con la información del SINAC que se les aporta ahora, aunado a la no inspección y no revisión de las ortofotos de meses atrás, sobre el bosque existente, es claro que nunca hubo un análisis del verdadero entorno ni de la significancia del impacto ambiental y esto acarrea a la nulidad de la licencia y también abre el paso a iniciar acciones contra los proyectistas y los consultores.

Como hemos señalado, incluso NUNCA se valoró el efecto acumulado de la tala irracional del bosque que han hecho todos los proyectos ubicados en el bosque en las fincas aledañas y por ello pedimos la nulidad absoluta de la licencia ambiental dado que existe vicios en el contenido y el motivo de la licencia ambiental indiscutiblemente.

En el ordinal 14 de la Convención sobre la Diversidad Biológica (Ley No 7416) tenemos que se señala, que las evaluaciones de impacto ambiental deben ser sumamente rigurosas para que únicamente se llegue a tener un impacto ambiental mínimo adverso, pero si se tomó como cierto que no existía un bosque, cuando sí lo existía y lo existe según SINAC, tenemos que la empresa y los consultores deben asumir su responsabilidad que tienen hoy acá y por ello pedimos aplicar la normativa del caso, incluso la convencional, debidamente ratificada.

Sobre los criterios fundamentales para acoger la revocatoria de licencia ambiental y la nulidad por violación al principio de tutela científica, véase por ejemplo los votos 200514293, y 2006-17126, donde la propia Sala Constitucional sigue esta línea:

"De la objetivación, de la tutela ambiental: el cual, tal y como lo señaló este Tribunal en sentencia número 14293-2005, de las catorce horas cincuenta y dos horas del diecinueve de octubre del dos mil cinco, es un principio que en modo alguno puede confundirse con el anterior [refiriéndose al principio precautorio], en tanto, como derivado de lo dispuesto en los artículos 16 y 160 de la Ley General de la Administración Pública, se traduce en la necesidad de acreditar con estudios técnicos la toma de decisiones en esta materia, tanto en relación con actos como de las disposiciones de carácter general —tanto legales como reglamentarias—, de donde se deriva la exigencia de la "vinculación a la ciencia y a la técnica con lo cual se condiciona la discrecionalidad de la Administración en esta materia. De manera que en atención a los resultados que se deriven de esos estudios técnicos —tales como los estudios de impacto ambiental—, si se evidencia un criterio técnico objetivo que denote la probabilidad de un evidente daño al ambiente, los recursos naturales o a la salud de las personas, es que resulta obligado desechar el proyecto, obra o actividad propuestas; y en caso de una "duda razonable" resulta obligado tomar decisiones en pro del ambiente (principio pro-natura), que puede traducirse en la adopción, tanto de medidas compensatorias como precautorias, a fin de proteger de la manera adecuada el ambiente." (El resaltado es nuestro) Es decir, como lo hemos venido exponiendo, incluso en caso de duda, sobre el mejor proceder, todo se debe inclinar por descartar el proyecto llevado hasta la fecha; dicho de otra manera, es necesario que exista una declaratoria de nulidad absoluta del acto habilitador ambiental, para que se tomen las medidas necesarias, oportunas y restaurativas.

Incluso en voto reciente (2022) de la Sala Constitucional, se ha señalado sobre el principio de objetivación:

"La jurisprudencia de la Sala es reiterada en el sentido de que las potestades legislativas deben estar vinculadas a reglas unívocas de la ciencia o la técnica, principios elementales de justicia, lógica o conveniencia, cuando el objeto de la actividad legislativa son las cuestiones ambientales, dado que el principio de objetivación de la tutela ambiental ha sido aplicado consistentemente por la jurisprudencia Constitucional (sentencias N 2010-000075 de las 15:01 horas del 6 de enero de 2010, 2012-013367; delas 11:33 horas del 21 de setiembre de 2012, 2013-005964 de las 15:05 horas del 30 de abril del 2013 y 2018-007978 de las 12:45 horas del 18 de mayo de 2018.) " Voto No 2022025307 de las trece horas cuarenta minutos del veinticinco de octubre de dos mil veintidós." (El resaltado es nuestro) Por lo dicho es manifiesto que el informe presentado por el biólogo confronta la información del SINAC y esa falta de criterio sirvió, para que luego Nombre02 avalara la cuestionable licencia ambiental, pero todo lo hecho por los consultores está permeado por violaciones a la legalidad, la transparencia, la constitucionalidad y al principio de tutela científica que deben conducir a revocar la licencia y a la apertura de órganos sancionatorios sin lugar a dudas.

Por otro lado también, tengamos muy presente que el ANEXO 3, dentro del REGLAMENTO GENERAL SOBRE LOS PROCEDIMIENTOS DE EVALUACIÓN DE IMPACTO AMBIENTAL' (EIA) Decreto Ejecutivo No. 31849-MINAE-S-MOPT-MAGMEIC de 24 de mayo del 2004. Publicado en La Gaceta No. 125 de 28 de junio del 2004, que señala:

"AREAS AMBIENTALMENTE FRÁGILES: Las AAE por su naturaleza, se dividen en dos grupos principales: a) aquellas áreas para las cuales el Estado ha definido un régimen especial de uso (marco jurídico y técnico definido); b) los espacios geográficos que muestran limitantes técnicas y ambientales para su uso... 10. Zona marítimo - terrestre. 11. Áreas con cobertura boscosa natural, (El resaltado es nuestro) Por todo ello pedimos la revocatoria de la licencia ambiental y mientras esto ocurre, rogamos se ordene la suspensión de los efectos de la licencia en aplicación al criterio precautorio, el preventivo y la inversión de la carga de la prueba.

SEGUNDO: Y es que incluso se detectó, como lo señalan desde la municipalidad, miles de metros cúbicos de tierra (10.000 mil o más) extraídos de la propiedad, que a la fecha no fueron valorados por Nombre02 y esto implica situaciones que definitivamente comprometen el ecosistema, el recurso suelo, la biodiversidad y por supuesto que la licencia ambiental y por ello pedimos que se revoque la misma por incumplimientos tan serios.

Nótese que incluso en la propia denuncia municipal, que es del 8 de agosto de este año, se señala que existe a la fecha un potencial ALTO de nuevos deslizamientos y por ello se solicita la intervención INMEDIATA de Nombre02 que debería tomar acciones más contundentes puesto que a pesar de la pendiente existente, incluso se construye una piscina que agrega más peso a la colina.

Es importante que esta Autoridad señale que los taludes NO fueron autorizados en la licencia ambiental ni tampoco las otras de mitigación o prevención, por lo que el proyecto es totalmente ilegal, dañino al ambiente y riesgoso para la vida de las personas y para bienes públicos como lo sería el camino que está debajo de lo que era un gran bosque.

TERCERO: Finalmente no logramos encontrar en el expediente de Nombre02 una cesión de la viabilidad ambiental del desarrollador originario, al actual, asunto que también abona en otra irregularidad y así pedimos disponerlo.

(…)

PRETENSIONES En consideración de todo lo anterior, solicitamos lo siguiente:

- Que se realice una investigación por parte de la unidad de auditoría y seguimiento ambiental de la SETENA.

- Que se ordene la nulidad absoluta por vicios de legalidad en licencia ambiental, donde incluso se debió de valorar mediante más exigencias ambientales y otros instrumentos y metodologías la viabilidad ambiental del proyecto.

- Que se diga que un proyecto a realizarse en un sitio de bosque debió ser tamizado bajo los estándares de valoración más rigurosos de Nombre02 pero ello no ocurrió y por tanto amerita acogerse la revocatoria de la licencia ambiental.

- Que se diga que es claro que por irresponsabilidad de los proyectistas nunca se valoró ambientalmente los miles de metros cúbicos que iban a sacar del proyecto y esto es sumamente irregular.

- Que se diga que las obras de mitigación y el alto potencial de deslizamientos nunca fue valorado por SETENA.

- Que se ordene la suspensión de la licencia ambiental, mientras se analiza esta denuncia.

- Que se diga que las únicas obras que se permitan sean las dedicadas a corregir restaurar y mitigar los impactos ambientales negativos generados.

- Que se aplique la garantía ambiental del proyecto Lati a la demolición respectiva y que los recursos se dediquen a la reposición del daño causado al ecosistema. Que se diga que la información de los consultores indujo a error a la SETENA. Que la denuncia del SINAC deja claro incluso que el camino de acceso al proyecto está en un bosque.

- Que se abran expedientes administrativos sancionatorios a los consultores ambientales involucrados y a la empresa por haber proporcionado datos, así como informes contradictorios o inexactos, que solo beneficiaron para que el proyecto obtuviera la viabilidad.

- De lo resuelto pedimos que se informe al Concejo de Distrito de Cóbano para que ellos procedan con la anulación del permiso de construcción.

- Que se disponga informar al Concejo de Distrito de Cóbano que el proyecto debe suspenderse desde ya como medida precautoria.

- Que se disponga la demolición de este proyecto.

- Que se inicien investigaciones y se ordene paralizar todos los proyectos de las fincas aledañas y que luego se ordene la revocatoria de todas las licencias ambientales de esos otros proyectos.

CUESTIONES DE TRAMITE MEDIDA CAUTELAR: INCIDENTE DE SUSPENSIÓN DE LICENCIA AMBIENTAL INICIALMENTE, se debe informar inmediatamente a la Comisión Plenaria de esta nueva prueba, que ahora se aporta, para que resuelva el recurso que se ha interpuesto contra el análisis que se hizo ante la primera denuncia.

Con base a lo señalado y el riesgo ambiental y social expuesto, dejamos presentado un incidente de suspensión, de la licencia ambiental, hasta que se resuelva esta gestión que presentamos dada la peligrosidad y las afectaciones a la biodiversidad que podrían ocurrir de seguirse adelante en un sitio que es de considerado como de alta fragilidad ambiental por existir un bosque.

PRIMERO.- Apariencia de buen derecho: Como hemos argumentado y aportado información tenemos que es claro que estamos ante violaciones al numeral 17 de la Ley Orgánica del Ambiente, puesto que el proyecto no ha sido valorado con rigurosidad y además constan informes de los consultores que indujeron a error a los funcionarios de SETENA.

La jurisprudencia del Tribunal Contencioso Administrativo ha señalado sobre la aplicación de los principios del derecho ambiental:

"Dentro de este ámbito, este Tribunal es sabedor de la extensa legislación sobre el marco tutelar del ambiente, así como de la relevante jurisprudencia que sobre el tema ha emitido la Sala Constitucional. Por demás, es evidente que en ese contexto, principios como el in dubio pro natura, precautorio, preventivo, quien contamina paga, reparación in natura, entre otros, constituyen herramientas de trascendental relevancia, que deben ser ponderadas por el juzgador en cada caso particular, a efectos de no hacer nugatorio el derecho contenido en el ordinal 50 referido. Pues bien, en el contexto del ambiente, los citados presupuestos deben valorarse acorde al contenido de los principios que impregnan el derecho ambiental, lo contrario, podría llevar a vaciar ese derecho y a permitir, vía omisiva, daños al medio..." Resolución número: 250-2010 de 8:00 horas del 29/01/2010, Tribunal Contencioso Administrativo, Sección VI.

En el Informe de inspección y denuncia sobre tala de bosque y cambios de uso, en Hermosa de Cóbano del SINAC a la Fiscalía, se señala que la finca del proyecto está ubicada en un sitio que es bosque. De hecho, en la denuncia se señala:

"En la inspección realizada el 12 de junio de 2023, se realiza un recorrido hasta los sitios indicados y colindantes con el expediente de Nombre02 D1-00092- 2022, donde se logra observar múltiples obras de movimientos de tierra, conformación de terrazas y apertura de camino en área de bosque de conformidad con la determinación de ecosistema de bosque ACT-OSRC-197-2023. El camino aparece en los planos como servidumbre de paso, sin embargo, este se habría elaborado en área de bosque. Al parecer las obras se realizan en las distintas propiedades mencionadas en el cuadro 1 y tienen en común el acceso por el camino habilitado e indicado en los planos como servidumbre de paso. A partir de las inspecciones de campo con el levantamiento de la información con el uso de un receptor de señal gps marca Garmin modelo GPSmap 64s y el uso de imágenes satelitales del servidor Planet Explorer, se delimitan los cambios observados en la cobertura forestal del sitio ocasionados posiblemente por las obras de construcción y el camino.

Esta información se sobrepone con las imágenes disponibles de los años del proyecto Carta del año 2005, Ortofotos 2014-2017, Google Earth diciembre 2021 y Planet Explorer de febrero 2023 ... De este procesamiento de información se obtiene una posible afectación de bosque aproximadamente 13.070,22 metros cuadrados... de igual manera se observa el camino utilizado como servidumbre de paso desprovisto de cobertura…” Obsérvese y valórese la tala de gran cantidad de árboles que ha informado la municipalidad pues ello sustenta aún más la apariencia de buen derecho que hemos argumentado.

Y es que si existe duda al respecto de la situación de bosque pedimos que a pesar de ello se aplique el principio de inversión en la carga de la prueba y de ser necesario se pidan aclaraciones al SINAC.

Tómese apunte de la normativa de la Ley Forestal incumplida por el cambio uso del suelo y además lo agravante del problema de destrucción de ecosistemas.

Por lo anterior, es que se cumple con este requisito apariencia de buen derecho al existir situaciones de hecho, normas y principios del derecho ambiental que amparan la medida solicitada.

SEGUNDO.- Peligro en la demora y daño grave: El requisito del periculum in mora debe basarse en los daños que podría sufrir el medio ambiente ponderado por sobre los intereses particulares o de la propia Administración Pública. Para este caso, como hemos señalado supra, estamos ante inminentes daños al recurso agua, bosque, paisaje y a la biodiversidad.

En la conferencia de Bergen, sobre Desarrollo Sustentable, se expuso comentando el principio precautorio:

“… es preferible estar más o menos acertado, pero a tiempo, dadas las graves consecuencias de una equivocación grande, que estar precisamente acertado, una vez que ya sea tarde..." (Rodrigo Walsh y otros. 2000. "Ambiente, derecho y sustentabilidad" Editorial La Ley. Argentina) El resaltado no es del original.

Se ha señalado sobre este requisito por parte de los Tribunales Contenciosos Administrativos: "Ahora bien, es claro que el daño requerido para el amparo cautelar ha de ser efectivo y real, con independencia de si es material, moral o de otro orden. Si bien es cierto no es preciso que sea actual, pues bien puede ser potencial, es decir, a futuro, ciertamente el daño ha de ser concreto y cierto" Resolución número: 250-2010 de 8:00 horas del 29/01/2010, Tribunal Contencioso Administrativo, Sección VI. (el resaltado es nuestro) El peligro en la demora queda visto también lo señalado por la municipalidad sobre EL ALTO POTENCIAL de deslizamiento que existe incluso en este agosto del 2023.

TERCERO.- Ponderación de intereses en juego: En este caso es fundamental detener todo el procedimiento aprobatorio hasta que se defina este recurso y el incidente de nulidad de la licencia ambiental, pues lo contrario podría generar MAS daños ambientales de forma continuada a los ecosistemas.

Se ha dispuesto judicialmente: "El acto que se impugna participa de las características apuntadas en considerandos anteriores, es decir, se trata de una medida cautelar orientada a proteger un bien jurídico de rango constitucional e internacional, cual es el medio ambiente, debiendo tenerse claro que los parámetros establecidos en el ordenamiento jurídico para la toma de estas medidas son especiales, rescatándose lo dicho antes, en el sentido de que , la toma de acciones por parte del Estado deben estar dirigidas siempre en favor del ambiente, aún y cuando existiere duda de si el disfrute del derecho del particular, que resultaría limitado con la medida, fuere la causa directa de la posible afectación del elemento que se ve comprometido." Resolución número 53-2009 de las 15:20 horas del 30/06/2009, Tribunal Contencioso Administrativo, Sección IX.

Nótese que de existir viviendas terminadas con personas viviendo allí en ese ecosistema boscoso, es un factor que afecta al bosque y su recuperación. Asimismo, es claro que se transgrede el principio de irreductibilidad del bosque.

Pedimos ver y valorar la nueva prueba que se complementa en todo lo que hemos señalado y evidencia la necesidad de ordenar suspender la obra YA.

SOBRE LA APERTURA DE PROCEDIMIENTOS ADMINISTRATIVOS SANCIONATORIOS Respecto a la apertura de procedimientos administrativos sancionatorios, pedimos que se nos tengan como partes denunciantes calificados y nos notifiquen lo pertinente.

La Sala Constitucional ha señalado sobre los denunciantes calificados:

"El denunciante cualificado puede ser titular de un interés legítimo o de un derecho subjetivo de modo que, de acuerdo con la más moderna doctrina del Derecho administrativo, debe reputársele, para todo efecto, como parte interesada en el procedimiento administrativo respectivo. Ese denunciante cualificado, al tener la condición de parte interesada, le asisten todos los derechos de tal y, específicamente, los derechos al debido proceso y la defensa, de modo que debe contar con la posibilidad efectiva de presentar alegatos, ofrecer prueba, participar en la producción de ésta y de recurrir cualquier resolución de trámite de efectos propios o final que se dicte. Negarle al denunciante cualificado la condición de parte y, por consiguiente, la posibilidad de ejercer el debido proceso y la defensa vulnera flagrantemente el Derecho de la NO 2015002787) Todo lo anterior, pues existe una clara obligación de cumplir con las normas y los procedimientos, pero en los informes existe información ya desmentidas por el SINAC que no se sustenta dentro de la ciencia y la técnica, yendo todo ello contra lo que establecen las normas reglamentarias sobre los deberes de los consultores.

El REGLAMENTO GENERAL SOBRE LOS PROCEDIMIENTOS DE EVALUACIÓN DE IMPACTO AMBIENTAL (EIA) Decreto Ejecutivo No. 31849-MINAE-S-MOPT-MAG-MEIC, señala que existen responsabilidades para los consultores ambientales que han incumplido deberes a partir de la norma 76, 83 102 siguientes y concordantes, que rogamos aplicar. Pedimos que se apliquen las sanciones de desinscripción a los consultores por las situaciones previstas en la norma 100 incisos 1 y 2. Finalmente, pedimos la ejecución de la garantía ambiental con fundamento en el numeral 92 del reglamento citado”.

Atinente a lo anterior, tal órgano determinó en resolución nro. 186-2024-Nombre02 de las 10:45 horas de 7 de febrero de 2024:

“PROYECTO RESIDENCIAS LATI Conoce la Comisión Plenaria de esta Secretaría el informe técnico INF-TEC-DT-ASA-0042- 2024, de fecha 25 de enero del 2024 sobre el proyecto: Residencias Lati, expediente: D10092-2022-Nombre02 (…)

CONSIDERANDO

PRIMERO: Que de conformidad con el artículo 282 de la Ley General de la Administración Pública (LGAP) Nº 6227, y con base en la documentación aportada al expediente, se tiene legitimado a Sivan Cibulski, documento de identificación CED06, apoderado legal Flor Rivas León, cédula de identidad CED02, como representante legal de la Sociedad Magna Pacific Sociedad de Responsabilidad Limitada, cédula CED03, para actuar dentro del expediente.

SEGUNDO: Que el Artículo 16 de la Ley General de Administración Pública N° 6227 establece que:

“En ningún caso podrán dictarse actos contrarios a las reglas unívocas de la ciencia o de la técnica, o a principios elementales de justicia, lógica y conveniencia…”.

TERCERO: Que el Artículo 19 de la Ley Orgánica del Ambiente N° 7554 estipula:

“Las resoluciones de la Secretaría Técnica Nacional Ambiental deberán ser fundadas y razonadas. Serán obligatorias tanto para los particulares, como para los entes y organismos públicos.” CUARTO: El Decreto Ejecutivo Nº 43898-MINAE-S- MOPT-MAG-MEIC, en el Artículo 56, establece:

“Las denuncias ambientales que se presenten contra una actividad, obra o proyecto en etapa de Evaluación de Impacto Ambiental o en etapa de seguimiento ambiental deberán gestionarse por los mecanismos digitales oficiales. La Nombre02 tramitará únicamente aquellas denuncias que sean de su competencia, conforme lo establecido en la resolución de viabilidad ambiental respectiva” Por lo anterior expuesto, se procede a brindar respuesta a la denuncia planteada en contra del proyecto.

QUINTO: La denuncia señala los siguientes hechos:

Hecho 1. De hecho, al existir bosque, se debieron cuando menos extremar las exigencias ambientales al pedir al desarrollador la más rigurosa valoración de impacto ambiental, pero ello no ocurrió y por esto amerita acoger nuestro pedido de revocatoria de la licencia ambiental.

Hecho 2. Y es que incluso se detectó, como lo señalan desde la municipalidad, miles de metros cúbicos de tierra (10.000 mil o más) extraídos de la propiedad, que a la fecha no fueron valorados por SETENA, y eso implica situaciones que definitivamente comprometen el ecosistema, el recurso suelo, la biodiversidad, y por supuesto que la licencia ambiental y por ello pedimos que se revoque la misma por incumplimientos tan serios.

Hecho 3. Finalmente, no logramos encontrar en el expediente de Nombre02 una cesión de la viabilidad ambiental del desarrollador originario, al actual, asunto que también abona en otra irregularidad y así pedimos disponerlo.

SEXTO: Las pruebas de descargo presentadas a las denuncias son los siguientes:

Hecho 1: Este hecho está orientado a la SETENA, donde le solicitan revocar la licencia ambiental; sin embargo, queremos aclarar que el Desarrollador y nuestra Representada aportaron en el estudio de impacto ambiental, todos los requisitos y estudios necesarios para obtener la viabilidad ambiental adecuada a reglamento, para desarrollar este tipo de proyectos. Además, en la misma prueba que aporta la parte denunciante (Informe SINAC) donde se enlistan las fincas que están en área bosque, no se incluye a la finca del partido de Puntarenas inscrita al folio real 244707-000 -y plano catastro número El informe ACTOSRC-20l -2023, que la parte denunciante refiere entre las nuevas pruebas, indica que la localización exacta del inmueble objeto del estudio es la siguiente: El sito se localiza en el distrito de Lepanto, del cantón central de provincia de Puntarenas, específicamente en el caserío Hermosa del distrito de Cóbano del cantón central de la provincia de Puntarenas, que podría comprender las fincas: 6-244707-000, 6-244715-000, 6- 244720-000, 6-244718000, 6-244709-000, 6-244708-000, 6-149464-000, 6-45156-000, 6- 151812-000, o sea, el informe involucra un total de nueve fincas, señal inequívoca, de que el estudio y posterior informe, no está centrado a determinar únicamente las condiciones del Proyecto Residencia Lati, tal y como lo quiere hacer creer la parte denunciante.

Sumado a lo anterior, debemos mencionar que en el informe ACT-OSRPL-197-2023, que la introducción indica: El presente documento contiene la evidencia literal geoespacial y de campo recabada con el objetivo de determinar si el sitio muestreado en Dirección03 del distrito de Cóbano del cantón central de la provincia de Puntarenas, entre las coordenadas 369678 - 1068900 y 369953 - 1068700, sistema de proyección CRTM05, que comprende las fincas Dirección04, 6244720-000, Dirección05, Dirección06 y Dirección07, dejando sin mención a la finca Dirección08.

Hecho 2: La afirmación de que el proyecto realizó movimientos de tierra por más de diez mil metros cúbicos (10.000m2), es totalmente errada, el proyecto realizó los movimientos de tierra conforme a lo indicado en la solicitud de evaluación ambiental. Parece maliciosa la afirmación de que el Desarrollador movilizó tal cantidad de tierra; porque el proyecto Residencia Lati se ajustó a realizar el movimiento de tierra indicado en la evaluación ambiental aprobada por SETENA. El propio ente municipal de la jurisdicción, mediante informes de inspección de sus propios colaboradores, determinó que no se podía cuantificar la cantidad en m3 de los movimientos de tierra, además los informes señalan que hay otros proyectos colindantes que han realizado movimientos de tierra significativos; sin embargo, omiten una realidad complemente demostrada por ellos mismos y que constan en informes elaborados por técnicos de la propia Municipalidad y el SINAC.

Además en la Resolución N° 1257-2023-SETENA, la cual se basa en inspección realizada por profesionales de esa Institución se indica “Se determina que el proyecto Lati no es el único proyecto en construcción ubicado en el sitio, dado que en el sector este existe un proyecto que se encuentra finalizando el movimiento de tierras e instalando medidas de mitigación para evitar el arrastre de material, por lo tanto, este pudo también contribuir a que en el mes de marzo se produjera una afectación a la vía pública. (El subrayado es nuestro).

(…)

Hecho 3: Respecto a este hecho, debemos aclarar que el Desarrollador y responsable del Proyecto sigue siendo el mismo de la Resolución 551-2022-SETENA, Proyecto Residencia Lati con número de expediente administrativo D1-0092-2022 a Nombre01 de Nombre03.

OTRAS CONSIDERACIONES INCLUIDAS EN LA DENUNCIA.

CONSIDERACIÓN 1.-CAMBIO DE USO DEL SUELO A LA HORA DE OTORGARSE LA LICENCIA AMBIENTAL PARA EL PROYECTO.

El uso de suelo emitido por el Concejo municipal de Cóbano, mediante el oficio ING-US412-2021 indica que el plano en cuestión, NO se encuentra afectado por ningún plan regulador y el uso de suelo residencial es CONFORME de acuerdo al reglamento de fraccionamientos y urbanizaciones. Por lo tanto, se emite uso de suelo RESIDENCIAL Y COMERCIAL, con las indicaciones respectivas de superficie mínima, frente mínimo, huella constructiva, altura máxima, alineamientos, prevención vial y retiros; y todos estos son respetados en el desarrollo del proyecto. Por lo tanto, no se ha realizado un cambio de uso de suelo.

CONSIDERACIÓN 2- TALA INDISCRIMINADA DOCUMENTADA CON INFORME Y FOTOGRAFÍAS. El proyecto cuenta con una certificación forestal elaborada el 11 de noviembre del año 2021 (antes de iniciar la construcción) en la cual se certifican varios tipos de cobertura entre ellas 2200 m2 de terreno de uso agropecuario sin bosque en la cual se ubica la mayor huella de infraestructura del proyecto la cual corresponde a las casas de habitación. Ver EXP: D1-0092-2022-Nombre02 Respuesta- PLANIFICACIÓN Y DISEÑO AMBIENTAL. La afirmación que el Proyecto Residencia Lati, incurrió en tala no autorizada, es incorrecto porque no se realizó ninguna tala indiscriminada, los árboles que requirieron de corta se encontraban en categorías diamétricas menores a 15 centímetros DAP, o eran especies exóticas que no requieren permiso de corta.

Para realizar corta de árboles que requerían permiso de corta, los permisos fueron tramitados a través de solicitud de permiso de corta en el SINAC, oficina subregional de Cóbano, que otorga el permiso para corta de 1 Guácimo y 1 Chaperno en Terrenos de Uso Agropecuario sin Bosque mediante la resolución ACT-OSRC-010-2023.

Adicionalmente, se realizaron otras acciones que consistieron en la poda de árboles, para lo cual no se requiere ningún permiso de la Administración Forestal del Estado.

Existe evidencia de tala indiscriminada en los proyectos vecinos, actos que fueron denunciados oportunamente por PLANIFICACIÓN Y Diseño Ambiental en la denuncia interpuesta el 12 de abril del año 2023 ante la Nombre02 y sobre los cuales aún no se ha tenido respuesta. Sin embargo, es evidente que la parte denunciante pretende minimizar incumplimientos y los impactos generados por otros proyectos de la zona colindantes con Proyectos Residencia Lati, enfocando su arsenal contra el proyecto Residencia Lati.

CONSIDERACIÓN 3- EXIGIR MEDIDAS RESTAURATIVAS Y EL PRINCIPIO DE IRREDUCTIBILIDAD DEL BOSQUE.

Respuesta- PLANIFICACIÓN Y DISEÑO AMBIENTAL. El bosque no se redujo, el mayor impacto de la infraestructura se realizó en terreno de uso agropecuario sin bosque tal y como consta en la certificación forestal emitida el 11 de noviembre del año 2021, y consta en el Expediente SETENA.

CONSIDERACIÓN 4 - SE HAN HECHO CAMINOS DE ACCESO DENTRO DEL PROPIO BOSQUE CON DAÑOS AMBIENTALES Respuesta- PLANIFICACIÓN Y DISEÑO AMBIENTAL. La finca donde se ubica el proyecto Residencia Lati cuenta con una servidumbre de acceso debidamente inscrita tal y como consta en la certificación literal de la propiedad. No existen pruebas de que el Desarrollador haya talado el bosque para constituir algún nuevo camino de acceso al Proyecto. Las imágenes satelitales no permiten determinar la existencia o no de cambios en la cobertura, a raíz de la construcción de la servidumbre, porque la misma se encuentra cubierta por la copa de los árboles aledaños.

CONSIDERACIÓN 5- LA DETERMINACIÓN DE QUE NO EXISTÍA BOSQUE EN EL ÁREA DEL PROYECTO FUE TOTALMENTE FALSA Respuesta- PLANIFICACIÓN Y DISEÑO AMBIENTAL. En los informes realizados por SINAC con número de resolución ACT-OSRC-201-2023 y ACT-OSRPL-197-2023, se determinó la definición de bosque en áreas aledañas que no corresponden directamente con el área del proyecto Residencia Lati. Situación evidente en todos los mapas representados, que determinan un área de influencia inmensamente mayor al área que abarca el proyecto Residencia Lati.

El área señalada con la flecha roja, se ubica el proyecto Residencia Lati, por lo que el sector, indicado en las resoluciones de SINAC, y del ente municipal que abarca otros proyectos, vecinos a Residencia Lati.

Hay que aclarar que el análisis de cobertura a partir de imágenes satelitales, permite determinar áreas con cobertura forestal, pero no permite distinguir de forma certera, entre distintos tipos de cobertura forestal, especialmente en los casos de imágenes de media o baja resolución. Además, la certificación forestal emitida el 11 de noviembre del año 2021, claramente indica que existe un área donde se desarrolló el proyecto Residencia Lati que correspondía a terreno de pasto con árboles dispersos, de los cuales algunos eran especies exóticas con diámetros mayores a 50 cm a 1.30 m de altura, específicamente individuos de Gmelina arborea Melina. Lo cual demuestra que este sector de la propiedad fue intervenido hace más de 30 años, siendo prueba fidedigna de que la cobertura en el área del proyecto fue intervenida antes de la entrada en vigencia de la ley forestal y la prohibición de cambio de uso del suelo.

CONSIDERACIÓN 6- TALA RASA SIN CRITERIOS, NI VALORACIONES TÉCNICAS, DE UN SITIO QUE TENÍA UNA CLARA COBERTURA BOSCOSA Y VOCACIÓN FORESTAL.

Respuesta- PLANIFICACIÓN Y DISEÑO AMBIENTAL. En el proyecto Residencia Lati, nunca se realizó “Tala rasa”. La denuncia, además introduce fotografías como elemento de prueba que induce a error, porque se aportan fotografías del informe de SINAC, mismo que incluye áreas que no corresponden al proyecto Residencia Lati, sino que corresponde a la totalidad del área evaluada por los inspectores de ACT para elaborar su informe y que involucró nueve fincas analizadas para fundamentar el informe elaborado y que se incorpora en la denuncia contra Residencia Lati. Esto nos obliga a advertir que existe error o mala fe, cuando aportan imágenes de proyectos que no tienen relación con Residencia Lati.

La cobertura arbórea que se aporta en las imágenes satelitales, no puede asociarse directamente con cobertura de bosque según la ley forestal, previamente hubo una valoración técnica, que da pie a una certificación forestal donde se clasificaron las coberturas presentes en el proyecto Residencia Lati. Es importante señalar que las fotos de los actos denunciados que muestran tocones en el sitio, no corresponden a áreas del proyecto Residencia Lati, sino que pertenecen a un proyecto colindante identificado como Hermosa Mountain House SRL.

CONSIDERACIÓN 7- NUNCA HUBO UN ANÁLISIS DEL VERDADERO ENTORNO, NI DEL IMPACTO AMBIENTAL QUE ABRE PASO A INICIAR ACCIONES CONTRA LOS PROYECTISTAS Y LOS CONSULTORES.

Respuesta- PLANIFICACIÓN Y DISEÑO AMBIENTAL De conformidad con el Manual de Instrumentos Técnicos para el Procedimiento de Evaluación de Impacto Ambiental: Parte II Decreto Ejecutivo No. 32712-MINAE, le Desarrollador a través del consultor ambiental, realizó y presentó el protocolo geológico, biológico, arqueológico, forestal y de ingeniería, y demás documentación solicitada, cumpliendo cabalmente con la legislación sobre evaluación ambiental vigente a la fecha de presentación del expediente, en caso contrario el Proyecto Residencia Lati no habría obtenido la viabilidad ambiental otorgada por SETENA, en la resolución 551-2022-SETENA.

CONSIDERACIÓN 8. TALA IRRACIONAL DEL BOSQUE HECHO POR LOS PROYECTOS UBICADOS EN LAS FINCAS ALEDAÑAS; POR ELLO PEDIMOS LA NULIDAD ABSOLUTA DE LA LICENCIA AMBIENTAL.

Respuesta- PLANIFICACIÓN Y DISEÑO AMBIENTAL. la parte denunciante pretende con su con los hechos denunciados, achacar toda la responsabilidad al Proyecto Residencia Lati, que dicho sea de paso, es el único que cuenta con la debida rotulación y seguimiento ambiental del proyecto, no sucede con proyectos vecinos. El Proyecto Residencia Lati obtuvo los permisos de corta emitido por la oficina subregional de Cóbano para el proyecto y no cortó sin el permiso correspondiente ninguna especie que ameritara permiso.

CONSIDERACIÓN 9. INFORME DE LA MUNICIPALIDAD, QUE INDICA QUE MILES DE METROS CÚBICOS DE TIERRA (10 000 MIL O MÁS) FUERON EXTRAÍDOS DE LA PROPIEDAD.

R- PLANIFICACIÓN Y DISEÑO AMBIENTAL En el proceso de evaluación ambiental se presentó la Declaración Jurada sobre movimientos de tierra donde se indicó que para el proyecto en cuestión el volumen de tierra para corte correspondía a 2055,74 m3 y para relleno se utiliza un volumen de 455,08 m3. Además, se indica que el Proyecto no requiere demolición, por lo que existirá un volumen irrelevante de escombros movilizándose fuera del proyecto, más allá de los generados en el proceso de construcción. Este volumen es muy inferior a los 10 000 m3 que se mencionan y nunca existió un movimiento de tierra de dicha magnitud, aunque la resolución de la SETENA, incluyó esa cantidad como autorizada. El material generado según la Declaración Jurada sobre movimientos de tierra, se movilizó al proyecto OB Hermosa Properties Ltda, con cédula jurídica CED04, Además, es importante destacar que el movimiento de tierra y la salida de material fuera del AP se realizó en noviembre del 2022, y los eventos ocurrieron en marzo del 2023, por lo que para esta fecha no existían acumulaciones de tierra dentro del proyecto que pudieran ser arrastradas por la lluvia.

CONSIDERACIÓN 10. LOS TALUDES NO FUERON AUTORIZADOS EN LA LICENCIA AMBIENTAL, POR LO QUE EL PROYECTO ES TOTALMENTE ILEGAL, DAÑINO AL AMBIENTE Y RIESGOSO PARA LA VIDA DE LAS PERSONAS Y PARA BIENES PÚBLICOS COMO LO SERÍA EL CAMINO QUE ESTÁ DEBAJO DE LO QUE ERA UN GRAN BOSQUE.

Respuesta- PLANIFICACIÓN Y DISEÑO AMBIENTAL. Durante el proceso de evaluación ambiental ante Nombre02 se cumplieron con todos los requisitos y se presenta el estudio de suelos y estabilidad de taludes, realizado por la empresa Perforaciones y consultorías Hidrotécnicas S.A., en septiembre del 2021. En las conclusiones del mismo informe se indica que: “...se concluye que el coeficiente de seguridad más bajo es de: 3.5 en condición pseudo estática lo cual indica que conforme al mínimo permitido conforme al Código de Cimentaciones de Costa Rica (FS >2 sin sismo) el área del proyecto presenta rangos de condición estable como bloque” El Estudio de Suelos parte del proceso de evaluación ambiental ante SETENA, y por lo tanto son parte de la viabilidad ambiental otorgada al proyecto. No es cierta la afirmación de la parte denunciante, que indica que los taludes no fueron considerados en la evaluación CONSIDERACIÓN 11- RESPECTO A LAS AMENAZAS NATURALES QUE ENFRENTA EL PROYECTO.

Respuesta- PLANIFICACIÓN Y DISEÑO AMBIENTAL. En el protocolo integrado de geología presentado ante Nombre02 como parte del proceso de Evaluación Ambiental, específicamente en el capítulo de datos sobre la condiciones de amenazas y riesgos naturales, el geólogo responsable Marco Araya Oviedo indica: “El Mapa de Amenazas Naturales potenciales de la Hoja Río Arío (CNE, 2002) y el Mapa de Amenazas Naturales Potenciales del cantón de Cóbano (CNE, 2013) indica que el AP no está ubicado en ninguna área de inundación o zona con inestabilidad de laderas”. Esto es respaldado por las observaciones de campo durante las cuales no se observaron evidencias de inestabilidad de taludes o problemas de erosión, confirmado por el estudio de suelos realizado incorporado en la evaluación ambiental.

El proyecto no se desarrolla en la zona de talud sino en zona de terraza, es por esta razón que en el resumen del protocolo correspondiente se hace referencia una pendiente de 5% la cual es la pendiente de la terraza en la cual se desarrolla el proyecto.

El evento que provocó arrastre de material en toda el área, de los proyectos ubicados en la zona, fueron eventos lluviosos que se presentaron en el mes de marzo, durante la época seca, hecho que debe considerarse, como un evento extraordinario que no se podía predecir, Por lo tanto, no había evidencias en sitio de posibles problemas de inestabilidad de taludes y erosión de taludes según las visitas realizadas por el equipo consultor, y además según las bases de datos oficiales de la Comisión Nacional de Emergencias tampoco existen registros de eventos de esta índole. Los eventos se dieron por eventos extraordinarios de lluvias intensas que están afectando todo el territorio nacional.

CONSIDERACIÓN 12- SOBRE ANOTACIONES Y REPORTES DEL REGENTE AMBIENTAL SOBRE AMENAZAS NATURALES QUE ENFRENTA EL PROYECTO, REPORTADOS EN INFORMES DE REGENCIA Y EN ANOTACIONES EN LA BITÁCORA AMBIENTAL DEL PROYECTO Respuesta- PLANIFICACIÓN Y DISEÑO AMBIENTAL. El 21 de febrero del 2023 se recomienda intervenir de la forma más anticipada posible el talud frente a calle pública del proyecto Residencia Lati, para garantizar el control de erosión durante la época lluviosa. La recomendada queda reportada y consta en las anotaciones de la Bitácora Ambiental para el Proyecto Residencia Lati. Atendiendo la recomendación, el día 22 de marzo de 2022, se inicia la colocación del geotextil en el talud frente a calle pública del proyecto Residencia Lati, con la finalidad de controlar la erosión del terreno del talud, hecho que mencionó en el Informe de Regencia Ambiental 1. El movimiento de tierra del resto del proyecto había finalizado para octubre de 2022 y la tierra ya había sido compactada.

El proyecto ha aplicado las medidas de mitigación, indicadas en la evaluación ambiental del proyecto, según lo han requerido las circunstancias del proyecto, por lo que todo impacto generado en la construcción del proyecto ha sido gestionada y mitigada de forma adecuada.

El 19 de enero de 2023, en la visita de regencia de Planificación y Diseño Ambiental DLS, la dirección técnica del proyecto Residencias Lati, alerta sobre movimientos de tierra realizados en propiedades vecinas en época festiva (24 dic- 2 ene). Esos movimientos de tierra no se reportaron en los informes porque no existía afectación directa de la acción sobre el AP. Por la magnitud, se le dio seguimiento visual durante las visitas de regencia y se incluyen en la bitácora del 22 de marzo de 2023.

SÉTIMO: Analizada la denuncia, pruebas de descargo, expediente, este departamento determina lo siguiente:

Análisis Hecho 1. De hecho, al existir bosque, se debieron cuando menos extremar las exigencias ambientales al pedir al desarrollador la más rigurosa valoración de impacto ambiental, pero ello no ocurrió y por esto amerita acoger nuestro pedido de revocatoria de la licencia ambiental.

Conclusión: El proyecto Residencias Lati obtuvo la Viabilidad mediante la Resolución No.551-2022-Nombre02 y como parte de los documentos aclaratorios presentados en el momento, fue aportada una Certificación forestal por parte del ingeniero Pablo Castillo Baldares, Regente Forestal, miembro ordinario del Colegio de Ingenieros Agrónomos número 5696, aclarando lo siguiente, copio textualmente “1. Según el Mapa de cobertura forestal Fonafifo 2000, el predio se encuentra en un área de cobertura de Bosque.

2.Durante la visita de campo se evidenció que la parte de mayor pendiente del predio corresponde a una regeneración natural joven. Las obras de infraestructura a realizarse, se ubican en áreas sin árboles, a excepción de 4 árboles de la especie conocida como guácimo (guazuma ulmifolia).

3.No se identificaron cuerpos de agua.

4.Se adjunta:

Por lo tanto, se certifica que existe un área aproximada de 2200 metros cuadrados del área del proyecto que no corresponde a bosque de acuerdo a la definición de bosque contenida en el artículo 3 de la ley forestal 7575. Así mismo no se evidencia que exista cambio de uso de la tierra posterior al año 2000”.

Por otra parte, en la Resolución de VLA, indicó que, si el proyecto requería la corta de árboles, debía tramitar previamente el permiso en la Oficina subregional local del MINAE/SINAC (art. 27 de la Ley Forestal). Según permiso aportado ACT-OSRC010-2023 el desarrollador solicitó los permisos de corta de árboles, donde se indica también que esta resolución fue elaborada por el funcionario evaluador según el informe de campo y evaluación ACT-OSRC-456-2022.

Es importante mencionar que, en los informes presentados en la denuncia, realizados por SINAC con número de resolución ACT-OSRC-201-2023 y ACTOSRPL-197-2023, no se pueden tomar de referencia debido a que se solicitó lo siguiente:

“1. Si las labores realizadas por el desarrollador bajo el plano P-2248092-2020, número de finca 244707-000, es donde indican que se observa movimientos de tierra, conformación de terrazas y apertura de caminos en área de bosque de conformidad con la determinación de ecosistema de bosque ACT-OSRC-197-2023.

2.Si a partir de las inspecciones de campo con el levantamiento realizado, pueden determinar que los cambios observados en la cobertura forestal corresponden a las construcciones y caminos del proyecto bajo el plano P-2248092-2020, número de finca 244707-000.

El informe técnico ACT-OSRPL-197-2023 del 27 de julio del 2022, Determinación de bosque acorde a la definición de Ley Forestal 7575 de Costa Rica, en la página 3, apartado introducción indica que el estudio comprende a las fincas 6-244715-000, 6-244720-000, 6-244718-000, 6-244709-000 y 6-2447708-000, dejando por fuera la finca donde se desarrolla el expediente D1-0092-2022-SETENA, Residencias Lati, plano P-2248092-2020, número de finca 244707-000, por esta razón precisamos nos indiquen si en esta propiedad hay o no bosque y tala del mismo.” El Área de Conservación Tempisque, en el oficio SINAC-ACT-OR-DR-1991-2023 con traslado de informe ACT-OSRC-274-2023, en respuesta a la consulta realizada mediante oficios SETENA-DT-ASA-1883-2023 y SETENA-DT-ASA-2140-2023, indican lo siguiente:

“1) Las labores realizadas por el desarrollador bajo el plano P-2248092-2020, número de finca 244707-000, forman parte de la denuncia por cambio de uso del suelo correspondiente a la causa 23-000028-0611-PE.

  • 2)El informe técnico ACT-OSRPL-197-2023 deja por fuera la finca donde se desarrolla el expediente D1-0092-2022- SETENA, Residencias Lati, plano P2248092-2020, número de finca 244707-000, considerando que al momento de la elaboración de la pericia de bosque, la cobertura prexistente en el sitio indicado había sido alterada y removida parcialmente, por tanto, no era viable utilizar esa área como testigo para el estudio.
  • 3)El código Procesal Penal dispone en su artículo 295, Privacidad de las actuaciones: “El procedimiento preparatorio no será público para terceros. Las actuaciones sólo podrán ser examinadas por las partes, directamente o por medio de sus representantes. Los abogados que invoquen un interés legítimo serán informados por el Ministerio Público sobre el hecho que se investiga y sobre los imputados o detenidos que existan, con el fin de que decidan si aceptan participar en el caso. Las partes, los funcionarios que participen de la investigación y las demás personas que, por cualquier motivo, tengan conocimiento de las actuaciones cumplidas, tendrán la obligación de guardar secreto. El incumplimiento de esta obligación será considerado falta grave.” Al ser un caso en investigación y que se está actuando bajo dirección funcional de la fiscalía de Cóbano este funcionario actúa en apego al código procesal penal en su artículo 295.

Por tanto, se les comunica que los hechos denunciados forman parte de una causa judicial abierta, la cual ha sido atendida por la oficina subregional de Cóbano y no puede ser divulgada”.

Por tanto, los estudios realizados por el SINAC, no pueden ser vinculantes, ya que no incluyen la finca donde se desarrolla el proyecto Residencias Lati con Expediente Administrativo D1-0092-2022-SETENA, como indican que forma parte de una causa judicial abierta, no puede ser divulgada.

Esta Secretaría en base a todos los criterios expuestos determina que se rechaza el hecho denunciado.

Análisis Hecho 2. Y es que incluso se detectó, como lo señalan desde la municipalidad, miles de metros cúbicos de tierra (10.000 mil o más) extraídos de la propiedad, que a la fecha no fueron valorados por SETENA, y eso implica situaciones que definitivamente comprometen el ecosistema, el recurso suelo, la biodiversidad, y por supuesto que la licencia ambiental y por ello pedimos que se revoque la misma por incumplimientos tan serios Conclusión: Dentro del formulario presentado durante el proceso de Evaluación de Impacto Ambiental, se contempla en el Impacto en Suelo lo siguiente:

¿Su AOP contempla movimientos de tierra?

Sí, se contempla movimientos de tierra con acarreo fuera del AP de volúmenes hasta de 10.000 m3 Indicar las medidas ambientales principales que se aplicarían para prevenir, mitigar, corregir o compensar el impacto ambiental que se generaría. Debe indicar si las medidas ambientales serán aplicadas durante la construcción o bien, durante la operación de la AOP:

Se realizará el movimiento de tierra de 2055,74 m3 y un relleno de 455,08 m3, este movimiento se hará de forma adecuada, y el material que salga del AOP se gestionará con una gestión autorizado el cual dispondrá de la material de forma adecuada. Además, se tomarán las medidas de salud y (sic) higiene en el equipo que saque el material del AOP.

Esta Secretaría en base al criterio expuesto determina que se rechaza el hecho denunciado.

Análisis Hecho 3. Finalmente, no logramos encontrar en el expediente de Nombre02 una cesión de la viabilidad ambiental del desarrollador originario, al actual, asunto que también abona en otra irregularidad y así pedimos disponerlo.

Conclusión: El desarrollador actual es la Sociedad MAGNA PACIFIC SOCIEDAD DE RESPONSABILIDAD LIMITADA, cédula jurídica CED05, mismo que solicitó y se le concedió la VLA en la Resolución Nº 551-2022-SETENA.

Esta Secretaría en base al criterio expuesto determina que se rechaza el hecho denunciado.

OCTAVO: Que el artículo 51 del Decreto Ejecutivo N° 43898, indica que la Nombre02 deberá programar y ejecutar inspecciones ambientales de seguimiento ambiental y control a las actividades, obras o proyectos, de forma aleatoria o bien cuando las implicaciones ambientales de la actividad, obra o proyecto, así lo requieran. En el desarrollo de las inspecciones los funcionarios de la Nombre02 fiscalizarán el que se esté dando un fiel cumplimiento de los compromisos ambientales suscritos y derivados del Cuadro Gestión Ambiental, el Código de Buenas Prácticas Ambientales.

POR TANTO

LA COMISION PLENARIA RESUELVE En sesión Ordinaria Nº 011 de esta Secretaría, realizada el 07 de febrero de 2024, en el Artículo Nº. 016 acuerda:

PRIMERO: Rechazar en forma total, la denuncia presentadas ante la Nombre02 el día 18 de agosto de 2023, mediante le consecutivo 08203-2023, el señor Álvaro Sagot Rodríguez apoderado de la señora [Nombre01 001], contra el proyecto Residencias Lati con expediente D1-0092-2022-SETENA.

SEGUNDO: Notificar a la municipalidad de Cóbano para que verifique los permisos de construcción y proceda según sus competencias.

TERCERO: Notificar al Área de Conservación Tempisque para el debido seguimiento, según sus competencias.

CUARTO: Contra esta Resolución cabe interponer dentro del plazo de tres días hábiles, contados a partir del día siguiente a la notificación, los recursos ordinarios de revocatoria ante la SETENA, y el de apelación ante el Ministro de Ambiente y Energía, de conformidad con los artículos 342 y siguientes de la Ley General de Administración Pública y 87 de la Ley Orgánica del Ambiente.

QUINTO: Toda documentación que sea presentada ante la Nombre02 deberá indicar claramente el número de expediente, el número de resolución y el Nombre01 completo del proyecto, así como un correo electrónico para atender futuras notificaciones o ratificar el que consta en el expediente administrativo.

SEXTO: Los documentos originales firmados digitalmente (Firma Digital) estarán a disposición del interesado en la dirección web http://www.setena.go.cr, donde debe ser verificado por cualquier interesado e instancia pública o privada.

SÉTIMO: El resultado de la discusión y análisis del caso de marras es: 6 a favor, 0 en contra y 1 ausente, el detalle de la información de dicha votación puede ser consultada en el acta correspondiente, la cual se encuentra en custodia de esta Secretaría y es de acceso público”.

Desde este panorama, en los términos desarrollados en el escrito de interposición, la parte accionante únicamente reprocha acciones y omisiones a la Setena. De ahí que concurro con el voto de la mayoría, toda vez que la referida denuncia fue resuelta por tal dependencia durante la tramitación del sub iudice. Asimismo, en tesis de principio, no corresponde a la Sala revisar si la licencia emitida cumple o no la legislación ambiental, ni tampoco si esta fue indebidamente otorgada o se presentaron irregularidadmente, si la parte accionante pretende cuestionar tal autorización, o bien, el fondo de lo resuelto por Nombre02 en la gestión, podrá someter a contradictorio su posición en las vías comunes y evacuar la prueba que estime pertinente. Finalmente, en el recurso de amparo no se atribuyeron hechos u omisiones al Sistema Nacional de Áreas de Conservación, por lo que prima facie es innecesario un análisis de constitucionalidad sobre esto.

X. VOTO SALVADO DE LOS MAGISTRADOS SALAZAR ALVARADO Y LARA GAMBOA, CON REDACCIÓN DEL PRIMERO

Con el debido respeto, disentimos del voto de mayoría que declara con lugar el recurso, con base en las siguientes razones:

La protección a un ambiente sano y ecológicamente equilibrado, en el Ordenamiento Jurídico Costarricense, está tutelado no solo en el artículo 50, de la Constitución Política, sino también en una serie de leyes y decretos ejecutivos (reglamentos) vigentes, tales como la Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; la Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; y el Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), para citar solo algunos. Esto hace necesario, en materia ambiental, separar el control de constitucionalidad del control de legalidad. En este sentido, es criterio de los suscritos que esta Sala, por vía de amparo, solo debe conocer un asunto en que se alega violación al derecho a un ambiente sano y ecológicamente equilibrado, si la Administración no ha intervenido aún y cuando la violación a ese derecho sea manifiesta y evidente, de fácil constatación, de cierta importancia o gravedad y que afecte, de forma directa, a alguna persona o comunidad en concreto.

De lo contrario, el tema debe plantearse y discutirse en la vía de legalidad. Por ello, el simple incumplimiento de obligaciones y deberes impuestos legalmente a las diversas administraciones públicas en materia ambiental es propio de ser conocido en la vía de legalidad –administrativa o jurisdiccional-, donde, con mucha mayor amplitud, podrán fiscalizarse los incumplimientos u omisiones que se acusen. Debe tenerse presente que el recurso de amparo es un proceso sumario, informal, sencillo y rápido, de manera tal, que desde el momento mismo en que la Administración interviene en un asunto ambiental, en ejercicio de sus competencias, y sustancia un procedimiento, con el dictado de actos administrativos, su conocimiento resulta ajeno al ámbito de acción de esta jurisdicción especializada. Por ello, la revisión de las actuaciones administrativas llevadas a cabo en torno a un tema ambiental que requiera, para su correcta valoración, de un proceso de conocimiento pleno, solo es posible en la jurisdicción ordinaria, toda vez que el diseño del proceso de amparo es incompatible con la contrastación o revisión de criterios técnicos o jurídicos elaborados al amparo de las normas legales o reglamentarias vigentes o con la evacuación de nuevos y mayores elementos de convicción necesarios para la contrastación o revisión de los criterios que ya consten en el expediente administrativo del caso.

Lo contrario implicaría transformar el amparo en un proceso ordinario de pleno conocimiento, con lo cual se desnaturalizaría y se tornarían nugatorios los fines para los cuales ha sido diseñado, con lo cual, perdería su condición de instrumento para la tutela eficaz de los derechos fundamentales. Como consecuencia de lo anterior, estimamos que cuando un ente u órgano público ha intervenido, en diversas formas, o ha dictado actos administrativos en relación con un asunto ambiental, su conocimiento y fiscalización corresponde a la jurisdicción de lo contencioso-administrativo. Es, precisamente, la verificación de la existencia de esa intervención administrativa lo que determina que el asunto sea competencia de la vía legalidad. En consecuencia, este recurso debió haberse rechazado de plano, ya que su objeto es una cuestión propia de ser discutida, analizada y resuelta en la vía de legalidad.

Empero, como no se hizo así, lo procedente es declararlo sin lugar, sin hacer pronunciamiento alguno con respecto al fondo de la cuestión planteada por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.

XI.Voto salvado de la magistrada Garro Vargas respecto a la partees durante su tramitación. Justa dispositiva de esta sentencia. Dice el artículo 52 de la Ley de la Jurisdicción Constitucional (LJC): “Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes”.

Mi interpretación sobre esa norma es la siguiente: Esa “resolución” es todo acto válido y eficaz por el cual la autoridad competente restituye en el goce del derecho conculcado. La frase “si fueren procedentes” se refiere a las costas. Es más, el artículo 197 del Código Procesal Contencioso-Administrativo, citado por la mayoría, sobre la base del artículo 14 de la LJC, justamente se refiere sólo a estas: a las costas.

Ciertamente, a tenor del artículo 48 de la Constitución Política (CP), el contenido esencial del derecho al recurso de amparo no es indemnizatorio sino restitutorio; sin embargo, el artículo 51 de la LJC señala: “Toda resolución que acoja el recurso condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas del recurso, y se reservará su liquidación para la ejecución de sentencia”.

Si el derecho ha sido violado y la Sala así lo constata, aún en caso de que haya sido restituido, podrían haber surgido daños y perjuicios. Por tal motivo, cabe la condenatoria en abstracto de éstos. Si no se hiciera así, si no se diera tal condenatoria, en el caso de que sí se hubieren dado, no habría título –derivado de este proceso– para reclamarlos, con lo que se podría violar el artículo 41 de la CP. Si a pesar de que se haya condenatoria en abstracto, no se han dado los daños y perjuicios, el juez en la vía ordinaria así lo declarará, pues sólo a él corresponde tener por probado la existencia real y la magnitud de los mismos.

Con la tesis defendida por la mayoría estimo que, contrario a lo que se busca, se estaría incentivando que la Administración respete los derechos sólo ante la existencia de un recurso de amparo. Resta decir que el artículo 52 de la LJC prevé la posibilidad de que, si se estima que es lo justo, la Sala condene en costas, aun cuando el derecho haya sido restituido.

En razón de lo anterior, salvo parcialmente el voto respecto de la parte dispositiva y ordeno la condenatoria en daños y perjuicios, pero no en costas.

XII.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso, sin especial condenatoria en costas, daños y perjuicios. El magistrado Castillo Víquez pone nota. El magistrado Cruz Castro consigna nota. Los magistrados Salazar Alvarado y Lara Gamboa salvan el voto y declaran sin lugar el recurso, por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado. La magistrada Garro Vargas salva parcialmente el voto y ordena la condenatoria en daños y perjuicios, pero no en costas. Notifíquese.
