Document Review 1 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty on diecinueve de abril de dos mil veinticuatro.

Writ of amparo (recurso de amparo) filed by [Nombre01 001], identity card No. [Valor CED03], [Nombre01 002], identity card No. [Valor 002], [Nombre01 003], identity card No. [Valor 003], [Nombre01 004], identity card No. [Valor 004], [Nombre01 005], identity card No. [Valor 005], [Nombre01 006], identity card No. [Valor 006], [Nombre01 007], identity card No. [Valor 007], on behalf of [Nombre01 008], legal entity identification No. [Valor 008], against the CONCEJO MUNICIPAL DE DISTRITO PAQUERA.

Findings of Fact (Resultando):

  1. 1In a written submission received through the Court’s Online Filing System on 8 de noviembre de 2023, the petitioners filed a writ of amparo against the Concejo Municipal de Distrito Paquera. They state that, over the years, they have been members of [Nombre01 008], women engaged in entrepreneurial activities in the Paquera area who, through restaurant operations and fishing, have been able to support their households. They explain that they held a possession permit (permiso de posesión) in the maritime-terrestrial zone (zona marítimo terrestre), which was not extended based on the arguments set forth in technical report No. 189-26-07-2023-PDPT-ZMT-PAQ of the Departamento de la Zona Marítimo Terrestre, solely on the ground that [Nombre01 008] had not built “an elegant restaurant.” In this regard, they note that this is an area with low human-development indicators and considerable difficulty in creating and obtaining employment, with a vulnerable population; they therefore believe the decision was arbitrary and failed to comply with the State’s duty to ensure the most appropriate and equitable distribution of wealth.Following the decision not to renew the permit, the association was forced to dismantle “Ranchito Mar Azul,” from which it provided food service to tourists, and the permit was subsequently granted to a foreign national, who brought in heavy machinery and environmentally unfriendly construction materials such as cement, reinforcing bar, gravel, and “perling,” among others. They state that the area is forested in character and that trees are being felled. They state that, for the purpose of exercising their rights as citizens, on 27 de setiembre de 2023 they submitted, via the email addresses ...01, ...02, and ...03, an application for absolute nullity (gestión de nulidad absoluta) before the Concejo Municipal de Distrito Paquera against the Council resolution (acuerdo del Concejo) adopting technical report No. 189-26-07-2023- PDPT-ZMT-PAQ, and that application has not been decided. They state that on 18 de setiembre de 2023, petitioner [Nombre01 003] sent an email to the email addresses ...01 and ...04, addressed to the Secretaría del Concejo Municipal and the Departamento de la Zona Marítimo Terrestre, requesting access to the administrative case files (expedientes administrativos), in the following terms: “Request for information regarding concession in ZMT Playa Leona.Denial of permit to [Nombre01 008] (…) pursuant to the constitutional right of access to public information, I request the following information: 1.- Copy of the Council (sic) resolution by which Technical Report number 189-26-07-2023-PDPT-ZMT-PAQ was adopted. 2.- An express statement as to whether the company RESORT PLAYA LEONA SRL, identification number CED01, and CONSORCIO INTERNACIONAL PUERTO LIMÓN hold any concession in the area formerly operated by [Nombre01 008], identification number [Valor 008]. 3.- Certification is likewise requested that the Council (sic) of Paquera, in observance of the ZMT law and the case law of the Sala Constitucional, will take action to guarantee public access to Playa la Leona, given that we have received reports indicating that access is being closed by a foreign national who apparently holds a concession…”. They complain that they have received no response, even though they have sent emails and called every office, but are told that the case file is not there, that it is being sought, that the Auditoría has it, that the engineer is handling it, or that it is in the Zona Marítimo Terrestre but the person in charge does not go there every day.They state that, tired of these explanations, on 27 de octubre de 2023 they sent an email to the following addresses: ...01, ...02, and ...04, corresponding to the Secretaría del Concejo Municipal, the Intendencia, and the Zona Marítimo Terrestre, with the following content: “… once again, I request that I be informed whether the information I requested, as well as the administrative case files, is now ready.” They state that, in response, they received an acknowledgment of receipt and remain awaiting delivery of the respective administrative case files. They add that attorney [Nombre01 003], on 20 de octubre de 2023, submitted via the email addresses ...01, ...02, and ...03 a formal motion for recusal (recusación) against all officials of the Zona Marítimo Terrestre, so that they would not adjudicate the application for nullity filed against the municipal resolution adopting technical report number 189- 26-07-2023-PDPT-ZMT-PAQ of that Departamento de Zona Marítimo Terrestre, which was based solely on the ground that [Nombre01 008] had not built an elegant restaurant.They state that they have likewise received no information regarding that motion for recusal. They recount that on 1 de noviembre de 2023 they received an email stating that the president of the Concejo Municipal had determined that the Council was not the body required to respond to them in this matter and that the request for an administrative response fell within the jurisdiction solely of a department of the Administration; that is, the response was to come from the Intendencia. On that same date, 1 de noviembre de 2023, the Intendencia replied that the case files requested by attorney [Nombre01 003] had been requested from Mr. Albán Ugalde, the official in charge of the Zona Marítima Terrestre, through referral TDGA-CMDP-597-2023; he, in turn, responded by official letter No. 31-31-10-2023-PDPT-ZMT-PAQ, stating that the case files were not located in the Departamento de la Zona Marítima Terrestre because, according to the logbook, they were with the Auditoría and Ingeniería, and that measures were therefore being taken to have them delivered to the Intendencia so that a response could be provided to Mr.Nombre02. In other words, the petitioners observe that the Intendencia also says it does not have the case files, and the fact remains that they still have no access to them. They believe that their fundamental right of access to public information and their right to prompt justice have been violated because they have not been given access to the administrative case files despite their numerous inquiries, telephone calls, and emails. They complain that they have likewise received no information concerning the motion for recusal sent to the Council and directed against the officials of the Departamento de la Zona Marítimo Terrestre—not even an acknowledgment of receipt—and object that the application for nullity against the municipal resolution adopting technical report number 189-26-07-2023-PDPT-ZMT-PAQ of the Departamento de la Zona Marítimo Terrestre has not been decided either. What they find even more troubling is that the Concejo Municipal referred the application for nullity to that same department for its officials to decide.They complain that Mr. Albán Ugalde, as the person in charge of those case files, has shown no interest in making them available, and that they have made countless telephone calls that are never answered by that Departamento de la Zona Marítimo Terrestre; official Albán Ugalde has also failed to answer a single one of the emails requesting information about the administrative case files. They state that after the Council denied the extension of [Nombre01 008]’s permit, the permit was given to a foreign company that has taken control of the area. They presume it is Resort Playa Leona Sociedad de Responsabilidad Limitada, legal entity identification number CED02, although they have been unable to confirm this because they lack access to the administrative case files. They state, however, that this company has restricted and closed the only public access to Playa La Leona in Paquera, with the inaction of the Concejo Municipal, by installing a gate that prevents entry through the sole access to the inalienable public zone (zona pública inalienable), where previously there had been no gate or obstruction of any kind.This is privatizing the beach and preventing access by both local residents and tourists. Another matter they identify as important is the felling of trees. They believe that environmental damage is being caused by the felling of quebracho trees without permits or technical opinions from the Sistema Nacional de Áreas de Conservación. They consider it abundantly clear that the foreign permit holder has carried out the felling in violation of the Ley Forestal and the “Reglamento para el trámite de los permisos y control del aprovechamiento maderable en terrenos de uso agropecuario, sin bosque y situaciones especiales en Costa Rica y oficialización del “Sistema de Información para el control del aprovechamiento forestal SICAF”.” They believe that the environmental damage extends beyond the felling of trees, since the ecosystem as a whole is being affected and this impact has not been assessed, as the permits from the authorities of the Ministerio de Ambiente y Energía are notably absent.They allege that there is no administrative act (acto administrativo) to challenge, but that this is nevertheless a constitutional matter because there is environmental damage and a violation of Article 50 of the Constitution resulting from unlawful conduct by private parties carried out with the acquiescence of the authorities of the Concejo Municipal del Distrito de Paquera, without any oversight by the environmental authorities. They contend that, because the area lies within the maritime-terrestrial zone, no private party or local institution may cut down trees, since they are part of the State’s natural heritage (patrimonio natural del Estado).
  2. 2By the ruling issued at 19:06 horas del 10 de noviembre de 2023, the amparo proceeding was admitted, and reports concerning the facts alleged by the petitioners were requested from the official in charge of the Departamento de la Zona Marítimo Terrestre, the intendant, and the president of the Council, all of the Concejo Municipal de Distrito Paquera, as well as from the head of the Oficina Subregional Lepanto-Paquera del Área de Conservación Tempisque.
  3. 3On 17 de noviembre de 2023, petitioner [Nombre01 003] submitted additional evidence to assist the Court in reaching a decision (prueba para mejor resolver).
  4. 4In a written submission received by the Sala via email on 21 de noviembre de 2023, Alban Ugalde García, in his capacity as head of the Departamento de la Zona Marítima Terrestre del Distrito de Paquera, reports under oath that, through technical report No. 189-26-07-2023-DPT-ZMT-PAQ dated 26 de julio de 2023, the following recommendation was made to the Comisión de Zona Marítima Terrestre: “That the application to renew the temporary use permit (permiso de uso temporal) granted to [Nombre01 008], LEGAL ENTITY IDENTIFICATION NUMBER [Valor 009], filed with this Department on 25 de Julio del 2023, …located in Playa La Leona, in the Playa Blanca de Paquera sector, which expires on 29 de agosto del 2023, be denied for the following reasons: A)-For failure to demonstrate a genuine social interest, because they never reflected or demonstrated such interest before this Concejo Municipal through proposals to create sources of employment or infrastructure compatible with the surrounding environment, such as the construction of an elegant restaurant.B)-That lot was severed from the land occupied by Consorcio Internacional Puerto Limón S.A; today, the land on which it is located belongs to RESORT PLAYA LEONA S.R. L., Legal Entity Identification Number: CED01, by virtue of a partial assignment by Consorcio Internacional Puerto Limón, and it is to that company, RESORT PLAYA LEONA S.R. L, that it must be returned; C)-Because [Nombre 008], LEGAL ENTITY IDENTIFICATION NUMBER [Valor 009], holds another temporary use permit granted by final Resolution of Ordinary Session Number: 100-2021 (P-2020-2024), held on 03 de Agosto del 2021. Article 6. Committee Reports, Subsection A, appearing at pages 110 to 119 of this Administrative Record (Expediente Administrativo), and it is not possible for them to hold more than one use permit at a time, pursuant to the final portion of Article 12 of the REGULATIONS FOR GRANTING USE PERMITS IN THE MARITIME-TERRESTRIAL ZONE IN THE DISTRICT OF PAQUERA, published in the Official Gazette La Gaceta N°. 159, on miércoles 20 de agosto del 2014, as amended.” He specifies that, when temporary use permits were granted in the maritime-terrestrial zone (zona marítima terrestre), the “Patrimonio Natural Del Estado” (PNE) was excluded.He maintains that, regarding the request for the administrative records relating to the matter alleged in the amparo proceeding (amparo), the email address ...05 identified by the petitioners does not exist; the Department’s email address is ...06, which has been in effect since 31 de enero de 2023. He states that the requested records are not held by the Department and that the municipal mayor was so advised in official letter 31-31-10-2023-DPT-ZMT-PAQ, in response to reference number TDGA-CMDP-597-2023, indicating that they are held by the Departamento de Ingeniería and the Departamento de Auditoría Interna. He states that [Nombre 008] was notified, through its president, Ms. Anyi Mariela Leitón Acosta, of the municipal resolution by which its temporary use permit in the maritime-terrestrial zone was not extended. He requests that the proceeding be dismissed.
  5. 5In a written submission received by the Sala via email on 23 de noviembre de 2024, Pedro Andrey Rojas Chaves, in his capacity as acting head of the oficina Subregional de Paquera-Lepanto del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación, reports under oath that, on 20 de noviembre de 2023, an inspection was conducted of the use permit granted by the Concejo Municipal de Distrito Paquera under expediente 862031 S.R.L.-2022, in the name of Nombre01 of Resort Playa Leona SRL. He specifies that, on 21 de noviembre de 2023, a complaint concerning the violations found was filed with the Fiscalía de Nicoya del Ministerio Público through incident report ACT-OSRPL-635-2023.
  6. 6In a written submission received through the Sala’s Gestión en Línea system on 31 de enero de 2024, petitioner [Nombre 003] states that, despite SINAC having filed a complaint with the Fiscalía Ambiental de Nicoya, tree felling, construction of a gate at the only public access to the beach, and the erection of structures continue. They request a ruling on the merits of the proceeding.
  7. 7In a written submission received through the Sala’s Gestión en Línea system on 1 de abril de 2024, petitioner [Nombre01 003] states that the only public access to the beach was completely blocked by the installation of a gate that remains closed 24 hours a day, 7 days a week. He asserts that the Concejo Municipal de Distrito Paquera has not provided him access to the records under which permission to block the public zone was granted. He requests that the proceeding be dismissed.
  8. 8According to a certification issued by the judicial technical officer responsible for this matter and by the acting secretary of the Sala Constitucional, neither the mayor nor the president of the Concejo, both of the Concejo Municipal del Distrito de Paquera, submitted a report.
  9. 9The statutory requirements have been observed in the processing of the proceeding.

Magistrate Sánchez Navarro drafts the opinion; and,

Whereas:

I.Preliminary issue. In view of the fact that the mayor and the president of the Concejo, both of the Concejo Municipal de Distrito Paquera, failed to submit their report within the period established by this Court in the ruling issued at 19:06 hours on 10 de noviembre de 2023, and pursuant to Article 45 of the Ley de la Jurisdicción Constitucional, the facts are deemed true with respect to those officials, and the Court proceeds to analyze their constitutionality based on the petitioners’ allegations.

II.Subject matter of the proceeding. The petitioners allege that they held a possessory permit (permiso de posesión) in the maritime-terrestrial zone located in Playa La Leona en Paquera, which was arbitrarily not extended, in breach of the State’s duty to guarantee the most appropriate and equitable distribution of wealth. They specify that they filed an application for absolute nullity (gestión de nulidad absoluta) and a motion for recusal (recusación) against the officials of the Departamento de la Zona Marítimo Terrestre; however, neither has been decided. They assert that they requested information relating to the permit at issue but received no response. They emphasize that the permit was granted to a foreign national who carried out tree felling, thereby causing environmental damage, because no permits or technical opinions from SINAC exist. They conclude that the only public access to Playa La Leona is being obstructed because a gate was installed that prevents entry to the beach.

III. Proven facts. The following facts are deemed duly established and relevant to the disposition of this matter

  • 1)The petitioners are members of [Nombre01 008] and held a use permit for the maritime-terrestrial zone in the Playa La Leona de Paquera sector until 29 de agosto de 2023, when the permit expired (see report of the respondent authority).
  • 2)Through technical report No. 189-26-07-2023-DPT-ZMT-PAQ dated 26 de julio de 2023, the Departamento de la Zona Marítimo Terrestre recommended the following to the Concejo Municipal del Distrito de Paquera: “That the application to renew the temporary use permit granted to [Nombre01 008], LEGAL ENTITY IDENTIFICATION NUMBER [Valor 009], filed with this Department on 25 de Julio del 2023, …located in Playa La Leona, in the Playa Blanca de Paquera sector, which expires on 29 de agosto del 2023, be denied for the following reasons: A)-For failure to demonstrate a genuine social interest, because they never reflected or demonstrated such interest before this Concejo Municipal through proposals to create sources of employment or infrastructure compatible with the surrounding environment, such as the construction of an elegant restaurant. B)-That lot was severed from the land occupied by Consorcio Internacional Puerto Limón S.A; today, the land on which it is located belongs to RESORT PLAYA LEONA S.R.

L, that it must be returned; C)-Because [Nombre 008], LEGAL ENTITY IDENTIFICATION NUMBER [Valor 009], holds another temporary use permit granted by final Resolution of Ordinary Session Number: 100-2021 (P-2020-2024), held on 03 de Agosto del 2021. Article 6. Committee Reports, Subsection A, appearing at pages 110 to 119 of this Administrative Record, and it is not possible for them to hold more than one use permit at a time, pursuant to the final portion of Article 12 of the REGULATIONS FOR GRANTING USE PERMITS IN THE MARITIME-TERRESTRIAL ZONE IN THE DISTRICT OF PAQUERA, published in the Official Gazette La Gaceta N°. 159, on miércoles 20 de agosto del 2014, as amended.” [Nombre01 008] was notified of the municipal resolution under which its temporary use permit in the maritime-terrestrial zone was not extended (see report of the head of the Departamento de Zona Marítimo Terrestre del Distrito de Paquera).

  • 3)On 18 de setiembre de 2023, the petitioner requested the following from the authorities of the Concejo Municipal del Distrito de Paquera through email addresses ...01 and ...04: “Request for information concerning a concession (concesión) in the ZMT at Playa Leona. Denial of permit to [Nombre01 008] (…) pursuant to the constitutional right of access to public information, I request the following information: 1.- A copy of the resolution of the Council (sic) adopting Technical Report number 189-26-07-2023-PDPT-ZMT-PAQ. 2.- An express statement as to whether RESORT PLAYA LEONA SRL, identification number CED01, and CONSORCIO INTERNACIONAL PUERTO LIMÓN hold any concession in the area that was operated by [Nombre01 008], identification number [Valor 008]. 3.- It is likewise requested that it be certified that the municipal Council (sic) of Paquera, in compliance with the ZMT law and the case law of the Sala Constitucional, will take action to guarantee public access to Playa la Leona, given that we have received complaints indicating that access is being closed by a foreign national who, in principle, holds a concession…” (see evidence submitted to the record).

  • 8)On 20 de octubre de 2023, the petitioner filed a motion for recusal against the officials of the Departamento de la Zona Marítimo Terrestre to prevent them from deciding the application for nullity that had been filed, sending it to email addresses ...01, ...02, and ...03 (see evidence submitted to the record).
  • 9)On 24 de octubre de 2023, the secretary of the Concejo Municipal del Distrito de Paquera acknowledged receipt of the motion for recusal filed by the petitioner (see evidence submitted to the record).
  • 10)On 24, 27 y 31 de octubre de 2023, the petitioner reiterated before the Secretaría del Concejo Municipal de Distrito Paquera the request for information relating to the permit at issue (see evidence submitted to the record).
  • 11)On November 1, 2023, the president of the Concejo Municipal de Distrito Paquera responded to the appellant by email, stating: “I hereby extend my greetings and, at the same time, offer the appropriate apologies. Please be advised that the document you submitted to this Council has been read during the correspondence portion of its meetings and referred to the Administration on repeated occasions through final resolutions. It is entirely clear that the Council is not the body that must respond in this case, since your request calls for an administrative response because it concerns a department over which only the Administration has authority. The Council neither omits nor evades responses when the requested matter is directly related to the Council, the Secretaría Municipal, or documents involving public information, minutes, among other matters, that have already been reviewed by the technical officer of the relevant department together with legal counsel” (see evidence submitted to the case file).
  • 12)On November 1, 2023, the Intendencia del Concejo Municipal de Distrito Paquera responded to the petitioner as follows: “The case files requested by Lic. [Nombre01 003] were requested from Mr. Alban Ugalde, the official in charge of the Zona Marítima, through referral TDGA-CMDP-597-2023. Mr. Alban responded through OFICIO N°31-31-10- 2023-DPT-ZMT-PAQ, stating that the case files are not located in the Zona Marítima because, according to the logbook, they are with the Audit and Engineering departments. Accordingly, the relevant actions are already being taken so that they may be delivered to this Intendencia and a response may be provided to Mr. Nombre02. Lic. [Nombre01 003], we apologize for the inconvenience and hope to provide you with a prompt response” (see evidence submitted to the case file).
  • 13)On November 20, 2023, the authorities of the oficina Subregional Paquera-Lepanto of the Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación inspected the use permit (permiso de uso) granted by the Concejo Municipal de Paquera under expediente No. 862031 S.R.L.-2022 to Nombre01 of Resort Playa Leona S.R.L. (see report of the regional director of the Área de Conservación Tempisque of SINAC).
  • 14)On November 21, 2023, the authorities of the oficina Subregional Paquera-Lepanto of the Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación filed a complaint (denuncia) with the Fiscalía de Nicoya del Ministerio Público regarding the violations identified as a result of the removal of State natural heritage (patrimonio natural del Estado) (see oficio No. ACT-OSRPL-635-2023 del 21 de noviembre de 2023).

IV. Unproven fact. The following relevant fact has not been established

Sole fact.- That the appellants filed a complaint regarding the alleged tree cutting with the Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación.

V.On the exercise of the right of petition and prompt response (derecho de petición y pronta respuesta), as well as the right of access to administrative information (derecho de acceso a la información administrativa), through electronic means. In judgment No. 2008-009670 de las 09:55 horas de 13 de junio de 2008, this Sala Constitucional, in addressing the right of petition and the use of electronic means (applicable mutatis mutandis to the right of access to administrative information), explained:

“(…) Within the framework of the information and knowledge society, fundamental rights may be exercised through new information technologies. As regards the right of petition and prompt response, the use of electronic means gives it new dimensions that must be weighed. Always bearing in mind its progressive and expansive effectiveness, while also taking into account that fundamental rights are not absolute, it may be concluded that, for purposes of exercising the right of petition and prompt response using the means made available by new technologies, it is important that the request be channeled through a freely accessible website of the public entity or body. In addition, that electronic domain must contain a hyperlink directed to an email address specifically designated to receive requests, whether concerning a particular matter or serving as an inbox for all types of submissions (…)” (emphasis not in the original).

Similarly, with respect to requests sent to unofficial email addresses when receipt is acknowledged or processing of the response begins, this Court stated in judgment No. 2019-2204 de las 09:15 horas de 8 de febrero de 2019:

“(…) Now, in view of the foregoing and after analyzing the evidence included in the record, the Sala considers the appellant’s claim in this regard to be well-founded because, although the email address to which the interested party sent his petition is not an official channel for receiving such submissions, the fact remains that the respondent acknowledged that it proceeded to process that request and that, upon receiving it, it became aware of it (…) Accordingly, the respondent Administration deemed itself apprised of the submission and took the appropriate steps to provide the required response (…)” (emphasis not in the original).

In the specific case, it is important to note that, pursuant to artículo 45 de la Ley de la Jurisdicción Constitucional, the email account ...01 is deemed an official channel of the Concejo Municipal del Distrito de Paquera because the respondent authorities did not submit the report requested by the Sala and the appellant received an acknowledgment of receipt from that email address. Consequently, it is deemed an official channel for receiving written submissions.

VI.In the sub lite, the appellant complains that he requested information related to the alleged permit but obtained no response.

In this regard, this Sala found it established that the petitioner did, in fact, request information on September 18, 2023. It is now particularly important to enumerate and analyze each of the questions posed by the appellant in order to determine which of them are protected by this Sala, as explained below:

Petition relating to access to information

  1. 3It is likewise requested that it be certified that, in compliance with the ZMT law and the case law of the Sala Constitucional, the Concejo Municipal de Paquera will take action to guarantee public access to Playa la Leona, given that we have received complaints indicating that access is being closed by a foreign national who allegedly holds a concession.

Request based on the applicants’ subjective criteria In the sub lite, it is established that items 1 and 2 of the submission contain two requests involving petition and access to information: “1.- Copy of the Council resolution by which Technical Report number 189-26-07-2023-PDPT-ZMT-PAQ was adopted 2.- An express statement as to whether the company RESORT PLAYA LEONA SRL, identification number CED01, and CONSORCIO INTERNACIONAL PUERTO LIMÓN hold any concession in the area previously operated by [Nombre01 008], identification number [Valor 008].” Item 3, on the other hand, concerns a request based on the applicants’ subjective criteria that action be taken to guarantee access to Playa La Leona. Consequently, this Constitutional Court considers that the present proceeding must be granted with respect to the right of petition and access to information. This is so, first, because it was established that, as of the date this amparo proceeding (amparo) was filed, namely, November 8, 2023, the respondent authorities—the intendant and the president of the Council, both of the Concejo Municipal del Distrito de Paquera—failed to submit the report in this proceeding.

Because there is no evidence refuting the appellant’s assertions, pursuant to artículo 45 de la Ley de la Jurisdicción Constitucional, this Court deems the allegations to be true, and the Secretaría Municipal had not provided the requested information.

Accordingly, the rights of petition and access to information enshrined in Articles 27 and 30 of the Constitución Política are deemed to have been violated.

VII.On the other hand, with respect to the complaint that the concession holder at Playa La Leona is cutting down trees, thereby causing environmental damage because there are no permits or technical opinions (criterios técnicos) from SINAC, the evidence submitted to the case file shows that the petitioner has not filed a formal written submission with the authorities of the Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación to raise the issue described in the initiating pleading. From this standpoint, he must be advised that this Sala may neither replace the active Administration (Administración activa) in the exercise of its powers nor act as a forum for processing complaints. The petitioner should bear in mind that the foregoing is not the same as exhaustion of administrative remedies (agotar la vía administrativa), but is simply an acknowledgment that this Court must not directly substitute its judgment for that of the Administration or supplant public offices in handling matters within their jurisdiction. Consequently, the appellant may, if he so wishes, formally submit his objections or claims in writing to the respondent authorities or pursue them through ordinary judicial proceedings (vía jurisdiccional ordinaria), where he may fully litigate the merits of the matter and assert his claims.

On this particular issue, the Sala has stated that complaints such as those raised by the appellants in this amparo must first be filed with the appropriate authorities. In judgment n.° 2017-020375 de las 11:00 horas del 19 de diciembre de 2017, it stated as follows:

“II.- ON THE SPECIFIC CASE. In the sub lite, the appellants have come directly before this Court to report a problem involving pollution caused by the channeling of sewage through their properties and into a river. However, it may be inferred from the appellants’ own statements that they have not filed any complaint with the competent authorities, in this case the Municipalidad de Flores de Heredia. Now, as has repeatedly been stated, this Court may neither replace the active Administration in the exercise of its powers nor act as a forum for processing complaints, as indicated in judgment 2016-001150 de las 14:30 horas del 26 de enero de 2016. Those considerations apply to the case under review because this Court finds no reason to depart from the position expressed in that judgment or any grounds for assessing the matter presented differently. Therefore, even if the petitioners consider it unnecessary, in situations such as this they must formally submit the aforementioned complaint to the respondent authorities before filing an amparo proceeding, so that those authorities may take the appropriate measures to resolve the reported problem or, failing that, pursue their claim through ordinary legal proceedings (vía de la legalidad ordinaria).

The foregoing is without prejudice to the appellants’ ability to pursue constitutional proceedings after an unreasonable period has elapsed without effective action by the Administration, provided that a fundamental right is threatened or infringed.” In any event, it is clear that, upon learning of the claimants’ complaints, the authorities of the Paquera-Lepanto Subregional Office of the Área de Conservación Tempisque of the Sistema Nacional de Áreas de Conservación inspected the use permit (permiso de uso) granted by the Concejo Municipal de Paquera under expediente No. 862031 S.R.L.-2022, to Nombre01 of Resort Playa Leona S.R.L., on 20 de noviembre de 2023. The following day, 21 de noviembre de 2023, those authorities filed a complaint with the Fiscalía de Nicoya of the Ministerio Público concerning the violations found as a result of the removal of the State’s natural heritage (patrimonio natural del Estado). For the reasons stated, the appeal must be dismissed with respect to this issue.

VIII.Regarding the right of use over the public zone of the maritime-terrestrial zone (zona marítimo terrestre). To properly decide this matter, it is appropriate to revisit what the Chamber has held regarding the legal regime governing the maritime-terrestrial zone. As this Chamber has repeatedly stated, the maritime-terrestrial zone forms part of the public domain (dominio público) and, as such, is inalienable and not subject to acquisitive prescription (imprescriptible); it therefore cannot be privately appropriated. By way of example, judgment number 2000-005295, issued at diez horas cuarenta y seis minutos del treinta de junio de dos mil, stated as follows:

“...in its settled case law, the Chamber has confirmed that the maritime-terrestrial zone is public-domain property (bien demanial o bien de dominio público), within the meaning of artículo 261 del Código Civil and, as such, is inalienable; accordingly, no private party may appropriate any portion of it. It should be noted that the Ley sobre la Zona Marítimo (sic) Terrestre, ley número 6043 del 2 de marzo de 1977, establishes this status in artículo 1, providing that this zone forms part of the national patrimony, belongs to the State, and is inalienable and not subject to acquisitive prescription. Likewise, artículos 9 y 10 designate as public domain a strip measuring doscientos metros, of which cincuenta constitute the public zone—one might say the ‘strictly public’ zone—while the remaining ciento cincuenta metros may be termed the ‘restricted zone’ (zona restringida), in which certain conditional possession by private parties is permitted (see, in this regard, judgments número 447-91 de las 15:30 horas del veintiuno de febrero de 1991 and 1975-91 de las 8:48 horas del 4 de octubre de 1991).

(...) As imposed by artículo 20 de la Ley sobre la Zona Marítimo Terrestre, the public zone may not be occupied under any title or under any circumstances, nor may any right over it be asserted, except for the exceptions established by the same law, the discussion of which is not appropriate in these proceedings. Nevertheless, in accordance with the case law and artículo 39 of the cited law, concessions may be granted solely within the sector known as the restricted zone.” It follows from the foregoing that the legal regime of the public zone precludes private parties from constructing buildings of any kind within it, unless they are works contemplated in artículo 18 de la Ley sobre la Zona Marítimo Terrestre, in which case approval must be obtained from the institutions specified for that purpose in that provision. In those exceptional circumstances and others established by the Law, when works occupy the public zone, those who design and carry them out must ensure the free and safe passage of persons and their public use; the institutions responsible for issuing the authorization shall therefore ensure compliance with this requirement (artículo 12 del Reglamento a la Ley sobre la Zona Marítimo Terrestre).

The legislature reserved a “strictly public” zone within the maritime-terrestrial zone in order to guarantee the free passage of persons and public use. artículo 23 de la Ley de Zona Marítimo Terrestre provides that the State or its municipalities must build roads to guarantee access to that public zone and therefore declared to be in the public interest every existing access road and every access road arising from the planning of the public zone’s development. For that reason, the Reglamento of the cited law states that, in exercising the right of public use, the general interest must always be borne in mind, and access to and free passage through the maritime-terrestrial zone must be guaranteed at all times. In the case under consideration, it was established that, as of the date this amparo proceeding (amparo) was filed, namely, 8 de noviembre de 2023, the respondent authorities—the intendant and the president of the Concejo, both of the Concejo Municipal del Distrito de Paquera—failed to submit their report in these proceedings.

Because there is no evidence discrediting the appellant’s statements, this Court, pursuant to artículo 45 de la Ley de la Jurisdicción Constitucional, deems the allegation established; moreover, the appellant submitted evidence—photographs—showing that public access to Playa La Leona, which is for public use, is closed by a gate. Consequently, this Chamber finds that public access to Playa La Leona is unavailable, thereby establishing a violation of the rights of the appellants and other inhabitants. The respondent authorities must also maintain the public entrance in good condition and guarantee access to and departure from the beach.

IX.Regarding the nonrenewal of the permit. A special State-ownership regime applies in the so-called maritime-terrestrial zone. That property is inalienable and not subject to acquisitive prescription; in other words, no private party may acquire rights over it. A use permit is a unilateral legal act (acto jurídico unilateral) issued by the Administration in the exercise of its functions, through which the beneficial ownership (dominio útil) of the property is placed in the hands of a private party, while the State always retains direct ownership (dominio directo) of the property. The precarious nature of any right or use permit is inherent in the institution and refers to the Administration’s ability to revoke it at any time, whether because the State needs to occupy the property fully, because of the construction of a public work, or for reasons of safety, hygiene, or aesthetics. This is because, whenever a conflict arises between the property’s purpose and the permit granted, the natural use of the public property must prevail.

Consequently, the domestic legal regime governing public-domain property places such property outside private commerce, and any permits granted over it shall therefore always be precarious and unilaterally revocable by the Administration when required by necessity or the general interest (see judgment No. 2003013558 de las 12:28 horas del 28 de noviembre de 2003). Accordingly, with respect to the appellant’s argument, the alleged disagreement constitutes a dispute falling outside the jurisdiction of this Court, because this Court does not review the legality of the Administration’s acts or decisions and must not supplant public offices in resolving matters which, by their nature and pursuant to the Law, must be decided by those offices. It is therefore not for this Court to determine the propriety of the decision made by the Concejo Municipal del Distrito de Paquera regarding the application to extend the permit granted over Playa La Leona to [Nombre01 008]. Thus, the application must be decided by the Administration or, where appropriate, by the ordinary courts, rather than in these constitutional proceedings.

X.Lastly, the claimant alleges that he filed an application for a declaration of absolute nullity (nulidad absoluta) and for the recusal (recusación) of the officials of the Departamento de la Zona Marítimo Terrestre because the possession permit (permiso de posesión) granted to [Nombre01 008] was not extended; however, no decision has been issued. The evidence submitted in the case file shows that the applications in question were dated 27 de setiembre and 20 de octubre, both de 2023, and were filed with the authorities of the Concejo Municipal del Distrito de Paquera. Given that any failure to respond to the complaint filed would, if established, constitute a violation of artículo 41 de la Constitución Política, the amparo is inadmissible for the following reasons.

XI.New administrative justice as a swift and effective mechanism for protecting the substantive legal interests (לית?zell) of persons subject to the Administration ( discouraged). The Sala Constitucional, since its establishment, has applied broad admissibility criteria in view of the absence of expeditious and swift procedural avenues for protecting substantive legal interests that are grounded in the subconstitutional legal system or the standard of legality and that are indirectly connected with fundamental rights and the Law of the Constitution (Derecho de la Constitución). In this regard, it must not be overlooked that the Constitution, by virtue of its supremacy, supra-legality, and direct and immediate effect, provides an indirect foundation for every conceivable substantive legal interest of individuals. Nevertheless, upon closer consideration and following the enactment of the Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) and its entry into force as of 1° de enero de 2008, it has become clear that litigants now have access to a plenary and universal administrative-law jurisdiction (jurisdicción contencioso-administrativa) that is exceptionally expeditious and swift owing to the various procedural mechanisms introduced into the legal system by that legislation.

These include shortened time limits for carrying out the various procedural acts; broad standing (legitimación); interim measures (medidas cautelares); an open-ended range (numerus apertus) of available claims; oral proceedings—and their subsidiary principles of concentration, immediacy, and expedition—; a single instance with a right of appeal in expressly specified situations; in-proceeding settlement (conciliación intra-procesal); unified proceedings (proceso unificado); expedited proceedings (proceso de trámite preferente), or an “amparo on grounds of legality” (“amparo de legalidad”); proceedings involving pure questions of law (procesos de puro derecho); new enforcement measures (coercive fines, substitute or court-appointed enforcement, and attachment of property in the fiscal domain and certain public-domain property); the broad powers of enforcement judges; the extension and adaptation of the effects of case law to third parties; and the flexibility of cassation review (recurso de casación).

The express aim and purpose of all these novel procedural institutions is to achieve procedural economy, expedition, promptness, and the effective and complete protection of the substantive legal interests of persons subject to the Administration, while guaranteeing basic fundamental rights such as due process, defense, and adversarial proceedings. In short, because of its new characteristics of simplicity, expedition, and promptness, the new administrative-law jurisdiction is an appropriate avenue for the effective safeguarding and protection of the substantive legal interests of persons subject to the Administration in cases requiring the gathering of evidence or the resolution of questions of ordinary legality.

XII.Verification of the time limits prescribed by law for deciding administrative proceedings: an evident matter of ordinary legality (legalidad ordinaria). It is evident that determining whether the public administration complies with the time limits prescribed by the Ley General de la Administración Pública (artículos 261 y 325) or by sector-specific laws for special administrative proceedings (procedimientos administrativos especiales), in order to conclude an administrative proceeding—instituted ex officio or at the request of a party—by means of a final administrative act (acto final), or to hear the applicable administrative appeals (recursos administrativos), is clearly a matter of ordinary legality that, henceforth, may be heard and decided before the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa), applying the principles underlying constitutional jurisdiction, such as vicarious standing (legitimación vicaria), the possibility of self-representation (defensa material)—that is, appearing without legal counsel—and access free of charge for the appellant. Consequently, the appeal must be summarily dismissed (rechazo de plano), and the petitioner must be advised that, if the petitioner so wishes, the matter may be brought before the contentious-administrative jurisdiction.

XIII.Documentation submitted to the case file (expediente). The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, these must be retrieved from the court within a maximum period of thirty business days following service of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI and published in the Boletín Judicial N° 19 del 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

The appeal for constitutional protection (recurso de amparo) is partially granted solely with respect to access to playa La Leona, as well as the right to petition and access information. Accordingly, the mayor and the president of the Council, both of the Concejo Municipal de Distrito Paquera, are ordered to adopt the appropriate and necessary measures so that, within a maximum period of ten days following service of this judgment, the information corresponding to points 1 and 2 of the request submitted by the appellant on 18 de setiembre de 2023 is provided, in accordance with the Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales, Ley No. 8968. Likewise, they must immediately take all measures required to guarantee the free passage of persons through the public access routes to the public zone (zona pública) of Dirección01. The respondents are warned that, pursuant to artículo 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an appeal for constitutional protection that the person must comply with or cause to be complied with, and fails to comply with it or cause compliance with it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The Concejo Municipal de Distrito Paquera is ordered to pay the costs, damages, and losses caused by the events giving rise to this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) in the contentious-administrative proceedings. Revisión del Documento 1 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del diecinueve de abril de dos mil veinticuatro .

Recurso de amparo interpuesto por [Nombre01 001], cédula de identidad No. [Valor CED03], [Nombre01 002], cédula de identidad No. [Valor 002], [Nombre01 003], cédula de identidad No. [Valor 003], [Nombre01 004], cédula de identidad No. [Valor 004], [Nombre01 005], cédula de identidad No. [Valor 005], [Nombre01 006], cédula de identidad No. [Valor 006], [Nombre01 007], cédula de identidad No. [Valor 007], a favor de la [Nombre01 008], cédula jurídica No. [Valor 008], contra el CONCEJO MUNICIPAL DE DISTRITO PAQUERA.

Resultando:

  1. 1Por escrito recibido mediante Gestión en Línea de la Sala el 8 de noviembre de 2023, los recurrentes interpusieron recurso de amparo contra el Concejo Municipal de Distrito Paquera. Manifiestan que a lo largo de los años han sido miembros de la [Nombre01 008], mujeres dedicadas a emprender en la zona de Paquera y, gracias a la actividad de restaurante y a la pesca, han podido llevar sustento a sus hogares. Describen que gozaban de un permiso de posesión en la zona marítimo terrestre, el cual, no fue prorrogado bajo los argumentos del informe técnico No. 189-26-07-2023-PDPT-ZMT-PAQ del Departamento de la Zona Marítimo Terrestre, bajo el único argumento que la [Nombre01 008] no había construido “un restaurante elegante “. Al respecto, señalan que se trata de un lugar con bajos índices de desarrollo humano y una gran dificultad para generar y conseguir empleo, con población en estado de vulnerabilidad, por lo que estiman que la decisión fue arbitraria e incumple con el deber del Estado de garantizar el más adecuado y equitativo reparto de la riqueza.Ante la decisión de no renovarles el permiso, la asociación se vio obligada a desmantelar el “Ranchito Mar Azul” desde el cual ofrecían servicio de alimentación a turistas y posteriormente el permiso fue otorgado a un extranjero, quien llevó maquinaria pesada y materiales de construcción poco amigables con el medio ambiente, tales como cemento, varilla, grava y “perling”, entre otros. Señalan que esa zona es de característica boscosa y que está produciendo una tala de árboles. Expresan que con la finalidad de ejercer sus derechos ciudadanos, el 27 de setiembre de 2023 plantearon, por medio de los correos electrónicos ...01, ...02 y ...03, ante el Concejo Municipal de Distrito Paquera una gestión de nulidad absoluta en contra del acuerdo del Concejo, que acogió el informe técnico No. 189-26-07-2023- PDPT-ZMT-PAQ, gestión que no ha sido resuelta. Expresan que el 18 de setiembre de 2023, el recurrente [Nombre01 003], remitió un correo a las direcciones de correo electrónico ...01 y ...04, dirigido a la Secretaría del Concejo Municipal y al Departamento de la Zona Marítimo Terrestre, con la solicitud de que se les brinde acceso a los expedientes administrativos, en los siguientes términos: “Solicitud de información sobre concesión en ZMT Playa Leona.Denegación de permiso a la [Nombre01 008] (…) al amparo del derecho constitucional de acceso a la información pública, solicito la siguiente información: 1.- Copia de acuerdo del Consejo (sic) mediante el cual se acogió el informe Técnico número 189-26-07-2023-PDPT-ZMT-PAQ 2.- Se nos indique expresamente si la empresa RESORT PLAYA LEONA SRL cédula CED01 y lo CONSORCIO INTERNACIONAL PUERTO LIMÓN tienen alguna concesión en la zona que era explotada por la [Nombre01 008] cédula [Valor 008]. 3.- Se solicita se certifique igualmente que el Consejo (sic) municipal de Paquera en respeto de la ley de ZMT y la jurisprudencia de la Sala Constitucional ejercerá las acciones para garantizar el acceso público a Playa la Leona en tanto tenemos denuncias que nos indican que el acceso está siendo cerrado por un extranjero que en principio ostenta una concesión…”. Reclaman que no se les ha contestado, pese a que han enviado correos y han hecho llamadas a todas las dependencias, pero les dicen que no está el expediente, que lo están buscando, lo tiene la Auditoría, lo maneja el ingeniero, o que está en la Zona Marítimo Terrestre pero que el encargado no va todos los días.Indican que cansados de esas explicaciones, el 27 de octubre de 2023 remitieron un correo electrónico dirigido a las siguientes direcciones: ...01, ...02, y ...04; correspondientes a la Secretaría del Concejo Municipal, a la Intendencia y a la Zona Marítimo Terrestre, con el siguiente contenido: “… nuevamente solicito se me indique si ya está lista esta información que solicité, así como los expedientes administrativos”. Indican que como respuesta recibieron una indicación de recibido y siguen a la espera de que les entreguen los expedientes administrativos respectivos. Agregan que el licenciado [Nombre01 003] planteó el 20 de octubre de 2023, por medio de las direcciones de correo electrónico ...01, ...02, y ...03, una formal recusación en contra de todos los funcionarios de la Zona Marítimo Terrestre, para que estos no fueran quienes conocieran de la gestión de nulidad planteada contra el acuerdo municipal que acogió el informe técnico número 189- 26-07-2023-PDPT-ZMT-PAQ de ese Departamento de Zona Marítimo Terrestre, bajo el único argumento que la [Nombre01 008] no había construido un restaurante elegante.Indican que tampoco se les ha informado nada sobre esa gestión de recusación. Relatan que el 1 de noviembre de 2023 recibieron un correo electrónico, según el cual, el presidente del Concejo Municipal determinó que no es el Concejo el que debe responderles en este caso y que la solicitud de respuesta administrativa corresponde a un departamento que tenga competencia únicamente con la Administración; es decir, que la respuesta la deben recibir de la Intendencia. En esa misma fecha, 1 de noviembre de 2023, la Intendencia contestó que los expedientes solicitados por el licenciado [Nombre01 003] fueron solicitados al señor Albán Ugalde, encargado de la Zona Marítima Terrestre, mediante el traslado TDGA-CMDP-597-2023, quien a su vez respondió mediante el oficio No. 31-31-10-2023-PDPT-ZMT-PAQ, indicando que los expedientes no se encuentran en el Departamento de la Zona Marítima Terrestre, pues según bitácora, están en la Auditoría y en Ingeniería, por lo que se están realizando acciones para que éstos sean entregados a la Intendencia y proceder a dar una respuesta al señor Nombre02.En otras palabras, observan los recurrentes que la Intendencia también dice no tener los expedientes y lo cierto es que siguen sin tener acceso a los mismos. Consideran que se ha violado su derecho fundamental de acceso a la información pública y el derecho a una justicia pronta, ya que no han tenido acceso a los expedientes administrativos pese a las múltiples consultas, llamadas y correos electrónicos. Reclaman que tampoco se les ha informado nada acerca de la recusación enviada al Concejo y que va dirigida contra los funcionarios del Departamento de la Zona Marítimo Terrestre, ni siquiera han obtenido un recibido y reprochan que tampoco se ha resuelto la gestión de nulidad contra el acuerdo municipal que acogió el informe técnico número 189-26-07-2023-PDPT-ZMT-PAQ del Departamento de la Zona Marítimo Terrestre, y lo que les parece más preocupante es que el Concejo Municipal trasladó la gestión de nulidad al mismo departamento para que sean ellos los que resuelvan.Reclaman que el señor Albán Ugalde, como encargado de esos expedientes no ha mostrado interés en facilitárselos y han realizado innumerables llamadas telefónicas que nunca son contestadas en ese Departamento de la Zona Marítimo Terrestre y el funcionario Albán Ugalde tampoco ha contestado uno solo de los correos en los que se solicita información acerca de los expedientes administrativos. Expresan que luego de que el Concejo denegara la prórroga del permiso a la [Nombre01 008], el permiso le fue entregado a una empresa extranjera que ha tomado el control de la zona; presumen que se trata de la empresa Resort Playa Leona Sociedad de Responsabilidad Limitada, cédula jurídica CED02, lo que no han podido confirmar por no tener acceso a los expedientes administrativos, pero señalan que esa empresa ha limitado y cerrado el único acceso público a Playa La Leona en Paquera, para lo que han contado con la inercia del Concejo Municipal, pues han instalado un portón que impide ingresar por el único acceso a la zona pública inalienable, acceso que antes no tenía ningún tipo de portón u obstáculo, con lo cual se está privatizando e impidiendo el acceso a la playa, tanto a los habitantes de la zona, como a los turistas.Otro aspecto que señalan como importante es la tabla de árboles. Consideran que está produciéndose un daño ambiental por la tala de árboles de quebracho sin que existan permisos, ni criterios técnicos del Sistema Nacional de Áreas de Conservación. Consideran que está muy claro que el extranjero permisionario ha realizado la tala al margen de la Ley Forestal y del “Reglamento para el trámite de los permisos y control del aprovechamiento maderable en terrenos de uso agropecuario, sin bosque y situaciones especiales en Costa Rica y oficialización del “Sistema de Información para el control del aprovechamiento forestal SICAF”. Consideran que el daño ambiental va más allá de la tala de árboles, en tanto existe una afectación en el ecosistema en general que no ha sido evaluado, porque se echan de menos los permisos de las autoridades del Ministerio de Ambiente y Energía. Alegan que no existe un acto administrativo que atacar, pero si se trata de un tema de constitucionalidad, en tanto existe un daño ambiental y una transgresión del artículo 50 constitucional producto de una ilegítima actuación de particulares bajo la vista y paciencia de las autoridades del Concejo Municipal del Distrito de Paquera, que no han ejercido ningún control por parte de las autoridades ambientales. Aducen que, al estar dentro de la zona marítimo terrestre, existe una prohibición para que cualquier particular o institución local pueda cortar árboles por ser patrimonio natural del Estado.
  2. 2Por medio de la resolución de las 19:06 horas del 10 de noviembre de 2023, se da curso al amparo y se solicita informe al encargado del Departamento de la Zona Marítimo Terrestre, intendente y presidente del Concejo, todos del Concejo Municipal de Distrito Paquera y jefe de la Oficina Subregional Lepanto-Paquera del Área de Conservación Tempisque, sobre los hechos alegados por los recurrentes.
  3. 3El 17 de noviembre de 2023, el recurrente [Nombre01 003] aportó prueba para mejor resolver.
  4. 4Por escrito recibido por correo electrónico de la Sala el 21 de noviembre de 2023, informa bajo juramento Alban Ugalde García, en su condición de encargado del Departamento de la Zona Marítima Terrestre del Distrito de Paquera, que por informe técnico No. 189-26-07-2023-DPT-ZMT-PAQ del 26 de julio de 2023, se recomendó a la Comisión de Zona Marítima Terrestre, lo siguiente: “Le sea denegada la solicitud de renovación del permiso de uso temporal otorgado a la [Nombre01 008], CEDULA JURÍDICA NUMERO [Valor 009], presentada en este Departamento en fecha 25 de Julio del 2023, …situado en Playa La Leona, del Sector de Playa Blanca de Paquera, el cual vence en fecha 29 de agosto del 2023, los siguientes motivos: A)-Por no haber demostrado un verdadero interés social, porque nunca lo reflejaron, ni lo demostraron ante este Concejo Municipal, con propuestas de fuente de empleo, de una infraestructura acorde con el entorno, sea con la construcción de un restaurante elegante.B)-Dicho lote le fue cercenado del terreno en ocupación de la Consorcio Internacional Puerto Limón S.A, hoy día donde se ubica ese terreno, pertenece a la Compañia RESORT PLAYA LEONA S.R. L., Cedula Jurídica Número: CED01, por cesión parcial de parte del Consorcio Internacional Puerto Limón, siendo a esta empresa a quien debe retornársele, a RESORT PLAYA LEONA S.R. L, C)-Porque la [Nombre 008], CEDULA JURÍDICA NUMERO [Valor 009], posee otro permiso de uso temporal, otorgado por Acuerdo en firme de la Sesión Ordinaria Número: 100-2021 (P-2020-2024), celebrada el 03 de Agosto del 2021. Artículo 6. Informes de Comisiones, Inciso A, visible a folios 110 a 119 de este Expediente Administrativo, no siendo posible que puedan disfrutar más de un permiso de uso a la vez, en aplicación del Artículo 12 in fine parte del REGLAMENTO PARA EL OTORGAMIENTO DE PERMISOS DE USO DE LA ZONA MARITIMA TERRESTRE EN EL DISTRITO DE PAQUERA" publicado en el Diario Oficial La Gaceta N°. 159, del miércoles 20 de agosto del 2014 y sus reformas”.Precisa que cuando otorgaron permisos de uso temporal en zona marítima terrestre, lo hicieron con exclusión del “Patrimonio Natural Del Estado” (PNE). Sostiene que en cuanto a la solicitud de los expedientes administrativos del caso alegado en el amparo, el correo electrónico ...05, que indican los recurrentes no existe, el correo electrónico del departamento es: ...06, el cual, rige desde el 31 de enero de 2023. Afirma que los expedientes requeridos no están en el Departamento, y así se le hizo ver al intendente municipal por oficio 31-31-10-2023-DPT-ZMT-PAQ, en respuesta al consecutivo: TDGA-CMDP-597-2023, indicándole que se encuentra en el Departamento de Ingeniería y en el Departamento de Auditoría Interna. Señala que a la [Nombre 008] les fue notificado el acuerdo municipal por medio del cual no se les prorrogó el permiso de uso temporal en zona marítima terrestre, a través de su presidenta, la señora Anyi Mariela Leitón Acosta. Solicita que se declare sin lugar el recurso.
  5. 5Por escrito recibido por correo electrónico de la Sala el 23 de noviembre de 2024, informa bajo juramento Pedro Andrey Rojas Chaves, en su condición de jefe a.i. de la oficina Subregional de Paquera-Lepanto del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación, que el 20 de noviembre de 2023 se realizó una inspección al permiso de uso otorgado por el Concejo Municipal de Distrito Paquera bajo el expediente 862031 S.R.L.-2022, a Nombre01 de la sociedad Resort Playa Leona SRL. Precisa que el 21 de noviembre de 2023 se interpuso la denuncia por las infracciones encontradas ante la Fiscalía de Nicoya del Ministerio Público, mediante el informe de hechos ACT-OSRPL-635-2023.
  6. 6Por escrito recibido mediante Gestión en Línea de la Sala el 31 de enero de 2024, el recurrente [Nombre 003], indica que a pesar de haberse interpuesto la denuncia por parte del SINAC ante la Fiscalía Ambiental de Nicoya, se continúa llevando a cabo la tala de árboles, construcción de un portón en el único acceso público a la playa, y la edificación de construcciones. Solicitan que se resuelva por el fondo el recurso.
  7. 7Por escrito recibido por Gestión en Línea de la Sala el 1 de abril de 2024, el recurrente [Nombre01 003] indica que el único acceso público a la playa fue completamente bloqueado, mediante la instalación de un portón que permanece cerrado las 24 horas del día y los 7 días de la semana. Afirma que el Concejo Municipal de Distrito Paquera no le ha dado acceso a los expedientes que otorgaron los permisos de bloqueo en zona pública. Solicita que se declare sin lugar el recurso.
  8. 8Según constancia de la persona técnica judicial a cargo del presente asunto, así como la secretaria a.i. de la Sala Constitucional, no rindió informe el intendente y presidente del Concejo, ambos del Concejo Municipal del Distrito de Paquera.
  9. 9En la substanciación del proceso se ha observado las prescripciones legales.

Redacta la Magistrada Sánchez Navarro; y,

Considerando:

I.Cuestión preliminar. En vista de que el intendente y presidente del Concejo, ambos del Concejo Municipal de Distrito Paquera, omitieron rendir el informe dentro del plazo fijado por este Tribunal en la resolución de 19:06 horas del 10 de noviembre de 2023, y de conformidad con el artículo 45 de la Ley de la Jurisdicción Constitucional, se tienen por ciertos los hechos en cuanto a esos funcionarios y se procede a analizar la constitucionalidad con base en lo expuesto por los recurrentes.

II.Objeto del recurso. Los accionantes alegan que gozaban de un permiso de posesión en la zona marítimo terrestre, ubicada en Playa La Leona en Paquera, el cual, no fue prorrogado, de manera arbitraria e incumple con el deber del Estado de garantizar el más adecuado y equitativo reparto de la riqueza. Precisan que interpusieron gestión de nulidad absoluta y recusación en contra de los funcionarios del Departamento de la Zona Marítimo Terrestre; sin embargo, no se ha resuelto. Afirman que solicitaron información relacionada con el permiso alegado, sin obtener resultado alguno. Resaltan que el permiso le fue otorgado a un extranjero, quien a efectuado una tala de árboles, produciéndose un daño ambiental, ya que no existen permisos ni criterio técnicos del SINAC. Concluyen que se impide el único acceso público a Playa La Leona, ya que se instaló un portón que impide el ingreso a la playa.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • 1)Las recurrentes son miembras de la [Nombre01 008] y tuvieron permiso de uso de la zona marítimo terrestre en el sector de Playa La Leona de Paquera, hasta el 29 de agosto de 2023, momento que venció el permiso (ver informe de la autoridad recurrida).
  • 2)Por informe técnico No. 189-26-07-2023-DPT-ZMT-PAQ del 26 de julio de 2023, el Departamento de la Zona Marítimo Terrestre le recomendó al Concejo Municipal del Distrito de Paquera, lo siguiente: “Le sea denegada la solicitud de renovación del permiso de uso temporal otorgado a la [Nombre01 008], CEDULA JURÍDICA NUMERO [Valor 009], presentada en este Departamento en fecha 25 de Julio del 2023, …situado en Playa La Leona, del Sector de Playa Blanca de Paquera, el cual vence en fecha 29 de agosto del 2023, los siguientes motivos: A)-Por no haber demostrado un verdadero interés social, porque nunca lo reflejaron, ni lo demostraron ante este Concejo Municipal, con propuestas de fuente de empleo, de una infraestructura acorde con el entorno, sea con la construcción de un restaurante elegante. B)-Dicho lote le fue cercenado del terreno en ocupación de la Consorcio Internacional Puerto Limón S.A, hoy día donde se ubica ese terreno, pertenece a la Compañia RESORT PLAYA LEONA S.R.

L., Cedula Jurídica Número: CED01, por cesión parcial de parte del Consorcio Internacional Puerto Limón, siendo a esta empresa a quien debe retornársele, a RESORT PLAYA LEONA S.R. L, C)-Porque la [Nombre 008], CEDULA JURÍDICA NUMERO [Valor 009], posee otro permiso de uso temporal, otorgado por Acuerdo en firme de la Sesión Ordinaria Número: 100-2021 (P-2020-2024), celebrada el 03 de Agosto del 2021. Artículo 6. Informes de Comisiones, Inciso A, visible a folios 110 a 119 de este Expediente Administrativo, no siendo posible que puedan disfrutar más de un permiso de uso a la vez, en aplicación del Artículo 12 in fine parte del REGLAMENTO PARA EL OTORGAMIENTO DE PERMISOS DE USO DE LA ZONA MARITIMA TERRESTRE EN EL DISTRITO DE PAQUERA" publicado en el Diario Oficial La Gaceta N°. 159, del miércoles 20 de agosto del 2014 y sus reformas”. A la [Nombre01 008] se les notificó el acuerdo municipal donde no se les prorrogó el permiso de uso temporal en zona marítima terrestre (ver informe del encargado del Departamento de Zona Marítimo Terrestre del Distrito de Paquera).

  • 3)El 18 de setiembre de 2023, el recurrente solicitó a las autoridades del Concejo Municipal del Distrito de Paquera, mediante las direcciones de correo electrónico ...01 y ...04, lo siguiente: “Solicitud de información sobre concesión en ZMT Playa Leona. Denegación de permiso a la [Nombre01 008] (…) al amparo del derecho constitucional de acceso a la información pública, solicito la siguiente información: 1.- Copia de acuerdo del Consejo (sic) mediante el cual se acogió el informe Técnico número 189-26-07-2023-PDPT-ZMT-PAQ 2.- Se nos indique expresamente si la empresa RESORT PLAYA LEONA SRL cédula CED01 y lo CONSORCIO INTERNACIONAL PUERTO LIMÓN tienen alguna concesión en la zona que era explotada por la [Nombre01 008] cédula [Valor 008]. 3.- Se solicita se certifique igualmente que el Consejo (sic) municipal de Paquera en respeto de la ley de ZMT y la jurisprudencia de la Sala Constitucional ejercerá las acciones para garantizar el acceso público a Playa la Leona en tanto tenemos denuncias que nos indican que el acceso está siendo cerrado por un extranjero que en principio ostenta una concesión…” (ver prueba aportada al expediente).
  • 4)El 19 de setiembre de 2023, la secretaria del Concejo Municipal de Distrito de Paquera, mediante correo electrónico ...01, le contestó al recurrente, dando acuse de recibido (ver prueba aportada al expediente).
  • 5)El correo electrónico oficial del Concejo Municipal del Distrito de Paquera para recepción de gestiones es ...01 (hecho incontrovertido).
  • 6)El 27 de setiembre de 2023, el recurrente interpuso gestión de nulidad absoluta en contra del acuerdo del concejo que acogió el informe técnico No. 189-26-07-2023-DPT-ZMT-PAQ, el cual, rechazó la renovación del permiso de la zona marítimo terrestre a la Asociación Mujeres de Sión. Se remitió a las direcciones de correo electrónico ...01, ...02, ...03 (ver prueba aportada al expediente).
  • 7)El 2 de octubre de 2023, la Intendencia y Auditoría, ambos del Concejo Municipal de Distrito de Paquera le brindaron acuse de recibido al recurrente, en cuanto a la interposición de la gestión de nulidad del acuerdo del concejo que acogió el informe técnico No. 189-26-07-2023-DPT-ZMT-PAQ (ver prueba aportada al expediente).
  • 8)El 20 de octubre de 2023, el recurrente interpuso recusación contra los funcionarios del Departamento de la Zona Marítimo Terrestre para que no resuelvan la gestión de nulidad presentado, a las direcciones de correo electrónico ...01, ...02, ...03 (ver prueba aportada al expediente).
  • 9)El 24 de octubre de 2023, el secretario del Concejo Municipal del Distrito de Paquera brindó acuse de recibido de la recusación interpuesta por el accionante (ver prueba aportada al expediente).
  • 10)El 24, 27 y 31 de octubre de 2023, el accionante reiteró su solicitud ante la Secretaría del Concejo Municipal de Distrito Paquera de la información relacionada con el permiso alegado (ver prueba aportada al expediente).
  • 11)El 1 de noviembre de 2023, el presidente del Concejo Municipal de Distrito Paquera le brindó respuesta al recurrente por medio de correo electrónico, indicándole: “Sirva la presente para saludarles y a la vez pedir las disculpas del caso. Hago de conocimiento que dicho documento que usted a presentado a este concejo ha sido leído en correspondencia y referido a la administración en repetidas ocasiones con acuerdos en firme. Queda enteramente claro que no es el concejo el que debe responder en este caso ya que su solicitud es de respuesta administrativa pues toca un departamento que tiene competencia únicamente con la administración. El concejo no omite ni evade respuestas cuando la instancia solicitada tiene relación directa con el concejo, secretaria municipal o alguna relación con documentos que están relacionados con información pública, de actas entre otras que ya hayan sido analizadas previamente por el técnico del departamento solicitado junto con la asesoría legal” (ver prueba aportada al expediente).
  • 12)El 1 de noviembre de 2023, la Intendencia del Concejo Municipal de Distrito Paquera le contestó al accionante, lo siguiente: “Los expedientes solicitados por el Lic. [Nombre01 003], fueron solicitados al señor Alban Ugalde, encargado de Zona Marítima, mediante el traslado TDGA-CMDP-597-2023, el señor Alban respondió mediante el OFICIO N°31-31-10- 2023-DPT-ZMT-PAQ, indicando que los expedientes no se encuentran en Zona Marítima, ya que según bitácora se encuentran en auditoria y en ingeniería, por lo que ya se están realizando las acciones pertinentes para que estos sean entregados a esta intendencia y proceder a darle una respuesta al señor Nombre02. Lic. [Nombre01 003], disculpas por los inconvenientes, esperamos darle una pronta respuesta” (ver prueba aportada al expediente).
  • 13)El 20 de noviembre de 2023, las autoridades de la oficina Subregional Paquera-Lepanto del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación efectuaron una inspección al permiso de uso otorgado por el Concejo Municipal de Paquera, bajo el expediente No. 862031 S.R.L.-2022, a Nombre01 de la sociedad Resort Playa Leona S.R.L. (ver informe del director regional del Área de Conservación Tempisque del SINAC).
  • 14)El 21 de noviembre de 2023, las autoridades de la oficina Subregional Paquera-Lepanto del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación interpusieron denuncia ante la Fiscalía de Nicoya del Ministerio Público, por las infracciones encontradas por la eliminación de patrimonio natural del Estado (ver oficio No. ACT-OSRPL-635-2023 del 21 de noviembre de 2023).

IV. Hecho no probado. No se tiene por demostrado el siguiente hecho de relevancia

Único.- Los recurrentes hayan interpuesto denuncia por la tala de árboles alegados ante el Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación.

V.Sobre el ejercicio del derecho de petición y pronta respuesta, así como el derecho de acceso a la información administrativa, a través de medios electrónicos. Esta Sala Constitucional, en la sentencia No. 2008-009670 de las 09:55 horas de 13 de junio de 2008, al referirse al derecho de petición y el empleo de medios electrónicos (aplicable mutatis mutandis al derecho de acceso a la información administrativa), explicó:

“(…) En el marco de la sociedad de la información y el conocimiento, los derechos fundamentales pueden ser ejercidos a través de las nuevas tecnologías de la información. En lo que al derecho de petición y pronta respuesta se refiere, la utilización de los medios electrónicos le da nuevos matices, los cuales, deben ser ponderados. Siempre teniendo en consideración su eficacia progresiva y expansiva, pero también, tomando en cuenta el carácter no absoluto de los derechos fundamentales, es posible concluir que, para el ejercicio del derecho de petición y pronta respuesta, empleando los medios que las nuevas tecnologías facilitan, es importante, que el requerimiento sea canalizado a través de una página web de libre acceso del ente o el órgano público. Adicionalmente, ese dominio electrónico debe contar con un hipervínculo direccionado hacia un correo electrónico dispuesto, específicamente, para recibir solicitudes, sea sobre un tema particular o bien que sirva como buzón para todo tipo gestiones (…)” (el énfasis no pertenece al original).

Paralelamente, en cuanto a solicitudes que son remitidas a correos no oficiales, pero su recibido se acusa o se inicia la tramitación de su respuesta, este Tribunal, en la sentencia No. 2019-2204 de las 09:15 horas de 8 de febrero de 2019, señaló:

“(…) Ahora bien, en vista de lo expuesto y luego de analizar los elementos aportados a los autos, la Sala considera que el reclamo del recurrente en este sentido, resulta procedente, toda vez, que si bien el correo electrónico al que el interesado remitió su petición, no constituye un medio oficial para la recepción de tales gestiones, lo cierto es que la parte recurrida admitió que ha procedido a tramitar dicha solicitud, siendo que al momento que la recibió, tuvo conocimiento de ella (…) Así las cosas, la administración recurrida se dio por conocedora de la gestión, y proveyó lo correspondiente para brindar la respuesta requerida (…)” (el énfasis no pertenece al original).

En el caso concreto, es importante acotar que en aplicación del artículo 45 de la Ley de la Jurisdicción Constitucional, la cuenta electrónica ...01, se tiene como medio oficial del Concejo Municipal del Distrito de Paquera, ya que las autoridades recurridas no rindieron el informe solicitado por la Sala y se brindó acuse de recibido al recurrente por parte de dicha dirección electrónica. En consecuencia, se tiene como medio oficial para recibir escritos.

VI.En el sub lite, reclama el recurrente que solicitó información relacionada con el permiso alegado, sin obtener resultado alguno.

Al respecto, esta Sala tuvo por demostrado que, efectivamente, el accionante solicitó información el 18 de setiembre de 2023. Ahora bien, es de especial importancia enumerar y analizar cada una de las interrogantes planteadas por el recurrente, con el fin de determinar cuáles de ellas se encuentran amparadas por esta Sala, según se expondrá a continuación:

Acceso a la información

  1. 2Se nos indique expresamente si la empresa RESORT PLAYA LEONA SRL cédula CED01 y lo CONSORCIO INTERNACIONAL PUERTO LIMÓN tienen alguna concesión en la zona que era explotada por la [Nombre01 008] cédula [Valor 008].

Petición en relación con acceso a la información

  1. 3Se solicita se certifique igualmente que el Consejo (sic) municipal de Paquera en respeto de la ley de ZMT y la jurisprudencia de la Sala Constitucional ejercerá las acciones para garantizar el acceso público a Playa la Leona en tanto tenemos denuncias que nos indican que el acceso está siendo cerrado por un extranjero que en principio ostenta una concesión.

Solicitud a partir de criterios subjetivos de los solicitantes En el sub lite, se verifica que existen dos solicitudes de petición y acceso a la información, en cuanto al punto 1 y 2 de la gestión: “1.- Copia de acuerdo del Consejo (sic) mediante el cual se acogió el informe Técnico número 189-26-07-2023-PDPT-ZMT-PAQ 2.- Se nos indique expresamente si la empresa RESORT PLAYA LEONA SRL cédula CED01 y lo CONSORCIO INTERNACIONAL PUERTO LIMÓN tienen alguna concesión en la zona que era explotada por la [Nombre01 008] cédula [Valor 008]”. Por otra parte, el punto 3 se refiere a una solicitud a partir de criterios subjetivos de los solicitantes para que se ejerzan acciones para garantizar el acceso a la Playa La Leona. En consecuencia, este Tribunal Constitucional considera que el presente proceso debe ser acogido en cuanto al derecho de petición y acceso a la información. Lo anterior, en primer término, en el tanto se demostró que, para el día de formulado el presente amparo, sea, el 8 de noviembre de 2023, la autoridad recurrida - intendente y presidente del Concejo, ambos del Concejo Municipal del Distrito de Paquera- omitieron rendir el informe en este proceso y, al no haber prueba que desacredite el dicho del recurrente, con base en el artículo 45 de la Ley de la Jurisdicción Constitucional, este Tribunal tiene por cierto lo acusado, y la Secretaría Municipal no había remitido la información requerida.

Por consiguiente, se tiene por vulnerado el derecho de petición y acceso a la información consagrados en los ordinales 27 y 30 de la Constitución Política.

VII.Por otra parte, en cuanto al reclamo porque se está efectuando una tala de árboles, por parte del concesionario de la Playa La Leona, produciéndose un daño ambiental, ya que no existen permisos ni criterio técnicos del SINAC. De la prueba aportada al expediente, el accionante no ha presentado una gestión formal y escrita ante las autoridades del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación, con el fin de plantear la problemática expuesta en el escrito de interposición. Desde este plano, se le debe advertir que esta Sala no debe sustituir a la Administración activa en sus competencias ni es una instancia tramitadora de denuncias. Tome en cuenta el petente que lo anterior no es lo mismo que agotar la vía administrativa, sino la simple admisión de que este Tribunal no debe sustituir directamente la voluntad de la Administración y suplantar a los despachos públicos en la gestión de los asuntos de su competencia. Por consiguiente, podrá la parte recurrente, si a bien lo tiene, plantear sus inconformidades o reclamos ante las autoridades recurridas de manera formal, por escrito, o bien, en la vía jurisdiccional ordinaria, sedes en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones.

Sobre este particular, la Sala ha manifestado que denuncias como las que plantean los recurrentes en este amparo, deben ser interpuestas previamente ante las autoridades correspondiente, por medio de la sentencia n.° 2017-020375 de las 11:00 horas del 19 de diciembre de 2017, se indicó lo siguiente:

“II.- SOBRE EL CASO CONCRETO. En el sub lite, la parte recurrente acude directamente a este Tribunal a denunciar un problema con respecto a la contaminación generada por una canalización de aguas negras a través de sus propiedades, las cuales desembocan en un río. Sin embargo, del propio dicho de las recurrentes se colige que no han planteado denuncia alguna ante las autoridades competentes, en este caso la Municipalidad de Flores de Heredia. Ahora bien, como se ha dicho reiteradamente, este Tribunal no debe sustituir a la Administración activa en sus competencias ni es una instancia tramitadora de denuncia, así lo señala la sentencia 2016-001150 de las 14:30 horas del 26 de enero de 2016. Consideraciones que son aplicables al caso en estudio, pues este Tribunal no encuentra razones para variar el criterio vertido en dicha sentencia, ni motivos que lo hagan valorar de manera distinta la situación planteada.

Por ende, aun cuando las promoventes lo consideren innecesario, en situaciones como esta es preciso que acudan ante las autoridades recurridas a plantear formalmente el reclamo aludido, de previo a interponer el recurso de amparo, para que sean dichas instancias las que tomen las medidas pertinentes para solucionar el problema denunciado o, en su defecto, establecer su reclamo en la vía de la legalidad ordinaria. Lo anterior sin demérito de que las recurrentes acudan a la vía constitucional, luego de que transcurriere un plazo irrazonable sin un actuar efectivo de la Administración y siempre que hubiere amenaza o lesión a un derecho fundamental.” En todo caso, se advierte claramente que al tener conocimiento de las reclamaciones de los accionantes, las autoridades de la oficina Subregional Paquera-Lepanto del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación efectuaron una inspección al permiso de uso otorgado por el Concejo Municipal de Paquera, bajo el expediente No. 862031 S.R.L.-2022, a Nombre01 de la sociedad Resort Playa Leona S.R.L., el 20 de noviembre de 2023.

Y el día siguiente, el 21 de noviembre de 2023, dichas autoridades interpusieron denuncia ante la Fiscalía de Nicoya del Ministerio Público, por las infracciones encontradas por la eliminación de patrimonio natural del Estado. Por las razones advertidas, se impone declarar sin lugar el recurso, en cuanto a este extremo.

VIII.Sobre el derecho de uso sobre la zona pública de la zona marítimo terrestre. Para la correcta resolución de este asunto, conviene retomar lo que la Sala ha dicho en relación con el régimen jurídico que ostenta la zona marítimo terrestre. Como ha manifestado reiteradamente esta Sala, la zona marítimo terrestre constituye parte del dominio público y, como tal, es inalienable e imprescriptible, por lo que no puede ser objeto de apropiación particular. A modo de ejemplo, en la sentencia número 2000-005295 de las diez horas cuarenta y seis minutos del treinta de junio de dos mil se dijo lo siguiente:

“...la Sala en reiterada jurisprudencia ha confirmado que la zona marítimo terrestre es un bien demanial o bien de dominio público, en los términos del artículo 261 del Código Civil y como tal, es inalienable, por ello ningún particular se puede adueñar de parte de ella. Debe hacerse notar, que la Ley sobre la Zona Marítimo (sic) Terrestre, ley número 6043 del 2 de marzo de 1977, en su artículo 1 establece dicho carácter, disponiendo que esa zona constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible. Asimismo, en sus artículos 9 y 10 determina como de dominio público una franja de doscientos metros de los que cincuenta son de zona pública, diríase "estrictamente pública" mientras que los restantes ciento cincuenta metros pueden denominarse como "zona restringida", en la que se permite cierta y condicionada posesión por los particulares (ver al respecto sentencias número 447-91 de las 15:30 horas del veintiuno de febrero de 1991 y 1975-91 de las 8:48 horas del 4 de octubre de 1991).(...) según lo ha impuesto el artículo 20 de la Ley sobre la Zona Marítimo Terrestre, la zona pública no puede ser objeto de ocupación bajo ningún título y en ningún caso, no pudiéndose tampoco alegar derecho alguno sobre ella, excepto las salvedades hechas por la misma ley, cuya discusión no es procedente en esta vía.

No obstante, de acuerdo con lo señalado por la jurisprudencia, así como por el artículo 39 de la ley citada, se permite el otorgamiento de concesiones, únicamente en el sector denominado como zona restringida.” De lo anterior se desprende que el régimen jurídico de la zona pública imposibilita que puedan levantarse edificaciones de ningún tipo en ella por parte de los particulares, salvo que se trate de las obras que contempla el artículo 18 de la Ley sobre la Zona Marítimo Terrestre, en cuyo caso se debe contar con la aprobación de las instituciones que para tal efecto en ese numeral se disponen. En esos supuestos de excepción y otros que la Ley determina, cuando las obras ocupen la zona pública será obligación de quienes las diseñen y ejecuten, garantizar el libre y seguro tránsito de las personas y el uso público de las mismas, por lo que las instituciones responsables de extender la autorización velarán por el cumplimiento de este requisito (artículo 12 del Reglamento a la Ley sobre la Zona Marítimo Terrestre).

El legislador reservó una zona “estrictamente pública” dentro de la zona marítimo terrestre con el fin de garantizar el libre tránsito de las personas y el uso público. El artículo 23 de la Ley de Zona Marítimo Terrestre dispone que el Estado o sus municipalidades deberán de construir vías, para garantizar el acceso a dicha zona pública, por lo que declaró de interés público, toda vía de acceso existente o que se origine en el planeamiento del desarrollo de la zona pública. Es por ese motivo, que el Reglamento de la ley de cita, indica que en el ejercicio del derecho al uso público, debe tenerse siempre presente el interés general, y garantizar en todo momento el acceso a la zona marítimo terrestre y el libre tránsito en ella. En el caso bajo estudio, se demostró que, para el día de formulado el presente amparo, sea, el 8 de noviembre de 2023, la autoridad recurrida - intendente y presidente del Concejo, ambos del Concejo Municipal del Distrito de Paquera- omitieron rendir el informe en este proceso y, al no haber prueba que desacredite el dicho del recurrente, con base en el artículo 45 de la Ley de la Jurisdicción Constitucional, este Tribunal tiene por cierto lo acusado, y se aportó prueba por parte del recurrente -fotografías- que el acceso público a la Playa La Leona de uso público se encuentra cerrado por un portón.

En consecuencia, esta Sala verifica que el acceso público a la Playa La Leona no es accesible, lo que implica que ha quedado constatada la violación a los derechos de los recurrentes y demás habitantes. Asimismo, las autoridades recurridas deberán conservar en buen estado la entrada pública, y garantizar la entrada y salida a la playa.

IX.Sobre la no renovación de permiso. Existe un régimen especial de propiedad del Estado en la llamada zona marítimo terrestre. Esa propiedad es inalienable e imprescriptible, es decir, ningún particular puede adquirir derechos sobre ella. El permiso de uso es un acto jurídico unilateral que lo dicta la Administración, en el uso de sus funciones y lo que se pone en manos del particular, es el dominio útil del bien, reservándose siempre el Estado, el dominio directo sobre la cosa. La precariedad de todo derecho o permiso de uso, es consustancial a la figura y alude a la posibilidad que la administración, en cualquier momento lo revoque, ya sea por la necesidad del Estado de ocupar plenamente el bien, por la construcción de una obra pública al igual que por razones de seguridad, higiene, estética, todo ello en la medida que si llega a existir una contraposición de intereses entre el fin del bien y el permiso otorgado, debe prevalecer el uso natural de la cosa pública.

En consecuencia, el régimen patrio de los bienes de dominio público, los coloca fuera del comercio de los hombres y por ello los permisos que se otorguen serán siempre a título precario y revocables por la Administración, unilateralmente, cuando razones de necesidad o de interés general así lo señalan (ver sentencia No. 2003013558 de las 12:28 horas del 28 de noviembre de 2003). En consecuencia, según lo planteado por el recurrente, cabe indicar que, la disconformidad alegada constituye un diferendo ajeno al ámbito de competencia de esta jurisdicción, ya que este Tribunal no es contralor de la legalidad de las actuaciones o resoluciones de la Administración ni debe suplantar a los despachos públicos en la resolución de los asuntos que, por su naturaleza y por mandato de la Ley, deban ser resueltos por ellos, de modo que no le corresponde determinar la procedencia de lo dispuesto por el Concejo Municipal del Distrito de Paquera, en relación con la solicitud de la prórroga del permiso otorgado a Playa La Leona a la [Nombre01 008]. De tal forma que, lo gestionado debe ser resuelto por la Administración o, en su caso, por la jurisdicción ordinaria y no en esta sede constitucional.

X.Por último, el accionante alega que interpuso gestión de nulidad absoluta y recusación en contra de los funcionarios del Departamento de la Zona Marítimo Terrestre, por no haberse prorrogado el permiso de posesión a la [Nombre01 008]; sin embargo, no se ha resuelto. De la prueba aportada al expediente se constata que las gestiones alegadas datan del 27 de setiembre y 20 de octubre, ambos de 2023, ante las autoridades del Concejo Municipal del Distrito de Paquera. Siendo que la eventual falta de respuesta de la denuncia planteada constituiría ser el caso, una violación al artículo 41 de la Constitución Política, por lo que el amparo resulta inadmisible, de conformidad con las siguientes consideraciones.

XI.Nueva justicia administrativa mecanismo célere y cumplido para la protección de situaciones jurídicas sustanciales de los administrados. La Sala Constitucional, desde su fundación, ha utilizado criterios amplios de admisibilidad en vista de la ausencia de cauces procesales expeditos y céleres para la protección de las situaciones jurídicas sustanciales que tienen asidero en el ordenamiento jurídico infra-constitucional o parámetro de legalidad, que guardan conexión indirecta con los derechos fundamentales y el Derecho de la Constitución. Sobre el particular, no debe perderse de perspectiva que la Constitución por su supremacía, súper-legalidad y eficacia directa e inmediata da fundamento indirecto a cualquier situación jurídica sustancial imaginable de las personas. No obstante, bajo una mejor ponderación y ante la promulgación del Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) y su entrada en vigencia a partir del 1° de enero de 2008, ha quedado patente que ahora los justiciables cuentan con una jurisdicción contencioso-administrativa plenaria y universal, sumamente expedita y célere por los diversos mecanismos procesales que incorpora al ordenamiento jurídico esa legislación, tales como el acortamiento de los plazos para realizar los diversos actos procesales, la amplitud de la legitimación, las medidas cautelares, el numerus apertus de las pretensiones deducibles, la oralidad –y sus subprincipios concentración, inmediación y celeridad-, la única instancia con recurso de apelación en situaciones expresamente tasadas, la conciliación intra-procesal, el proceso unificado, el proceso de trámite preferente o “amparo de legalidad”, los procesos de puro derecho, las nuevas medidas de ejecución (multas coercitivas, ejecución sustitutiva o comisarial, embargo de bienes del dominio fiscal y algunos del dominio público), los amplios poderes del cuerpo de jueces de ejecución, la extensión y adaptación de los efectos de la jurisprudencia a terceros y la flexibilidad del recurso de casación.

Todos esos institutos procesales novedosos tienen por fin y propósito manifiesto alcanzar la economía procesal, la celeridad, la prontitud y la protección efectiva o cumplida de las situaciones jurídicas sustanciales de los administrados, todo con garantía de derechos fundamentales básicos como el debido proceso, la defensa y el contradictorio. En suma, la nueva jurisdicción contencioso-administrativa es un cauce idóneo, por sus nuevas características de simplicidad, celeridad y prontitud para el amparo y protección efectiva de las situaciones jurídicas sustanciales de los administrados en las que se requiera recabar prueba o definir algunas cuestiones de legalidad ordinaria.

XII.Verificación de los plazos pautados por ley para resolver los procedimientos administrativos: cuestión evidente de legalidad ordinaria. Es evidente que determinar si la administración pública cumple o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes, es una evidente cuestión de legalidad ordinaria que, en adelante, puede ser discutida y resuelta ante la jurisdicción contencioso-administrativa con la aplicación de los principios que nutren la jurisdicción constitucional, tales como los de la legitimación vicaria, la posibilidad de la defensa material –esto es de comparecer sin patrocinio letrado- y de gratuidad para la recurrente. Consecuentemente, se impone el rechazo de plano e indicarle al gestionante que si a bien lo tiene puede acudir a la jurisdicción contencioso-administrativa.

XIII.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara parcialmente con lugar el recurso, únicamente, en cuanto al acceso a la playa La Leona, así como el derecho de petición y acceso a la información. En consecuencia, se ordena al intendente y presidente del Concejo, ambos del Concejo Municipal de Distrito Paquera, que adopten las medidas adecuadas y necesarias para que, en un plazo máximo de diez días contados a partir de la notificación de esta sentencia, se brinde la información correspondiente a los puntos 1 y 2 de la gestión planteada por el recurrente el 18 de setiembre de 2023, de conformidad con lo establecido en la Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales, Ley No. 8968. Asimismo, de inmediato deben tomar todas las medidas requeridas para garantizar el libre paso de las personas por los accesos públicos a la zona pública de la Dirección01. Se advierte a los recurridos que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena al Concejo Municipal de Distrito Paquera al pago de las costas, daños y perjuicios ocasionados por los hechos que han dado lugar a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. Notifíquese. - Fernando Castillo V.
