RESOLUCIÓN Nº 2024009584 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours twenty minutes on the twelfth of April, two thousand twenty-four.

A recurso de amparo (writ for protection of constitutional rights) processed in expediente No. 24-006886-0007-CO, filed by FREDDY JAVIER FLORES BUSTOS, identity card number 0109980731, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS and the MUNICIPALIDAD DE ALAJUELITA.

Resultando:

1.- By a document added to the Costa Rican Judicial Office Management System of this Chamber on March 13, 2024, the petitioner filed a recurso de amparo against the Instituto Costarricense de Acueductos y Alcantarillados and the Municipalidad de Alajuelita. He states that the Palo Campano Urbanization, located behind the Liceo de Alajuelita, and the communities of San Josecito, Tejarcillos, and San Felipe, have the Human Development Park, inaugurated on July 12, 2023, less than a year ago -https://www.mcj.go.cr/sala-de-prensa/noticias/parque-para-el-desarrollo-humano-de-alajuelita-se-inaugura-este-viernes-. He indicates that the park presents a significant problem related to vandalism, theft of plastic garbage cans, destruction of areas where children play, damage in common areas for sharing, illegal dumping (tiradero de basura), garbage burning, drinking fountains without water, among others. He states that in recent days, he proceeded to inform via emails to the electronic address [email protected], and in person, the mayor of Alajuelita about these issues and, in addition, the water leak that exists in the Human Development Park which, at this moment, is the most serious matter, but nothing has been done despite the fact that according to the Instituto Costarricense de Acueductos y Alcantarillados it is the responsibility of the Municipalidad de Alajuelita to make the repairs for that leak. He recounts that he could fill this appeal with documentary sources when exposing the problem of water, since it is not only generalized in the country, but also the nearby communities are affected by the shortage of water, as the tanks that supply the area do not fill. He adds that unfortunately the emails go back and forth without the Instituto Costarricense de Acueductos y Alcantarillados reaching an agreement with the Municipalidad de Alajuelita, as the respondent institute indicates that it is not their responsibility to repair the leak because it is outside their jurisdiction and the municipality does nothing to prevent thousands of liters of water from being lost daily, for more than two months, thus causing a decrease in the water supply throughout the canton. He considers that such action violates his fundamental rights.

2.- By a Presidency resolution at 10:24 hours on March 15, 2024, this amparo was admitted for processing.

3.- By a document incorporated into the digital file on March 21, 2024, Juan Manuel Quesada Espinoza reports under oath in his capacity as executive president of the Instituto Costarricense de Acueductos y Alcantarillados, who states the following: "... Having reviewed the petitioner's allegations, we proceed to render this Report based on the content of memorandum No. SG-GSGAM-MZOESTE-2024-00363, subscribed on March 20, 2024, by Eng. Iván Paniagua Arias of the Macro Zona Oeste GAM of AyA, and its annex 'INFORME RESPUESTA OFICIO 05032024', dated March 12, 2024, memorandum PRE-2024-00256, subscribed on March 20, 2024, by Licda. Brenda Soto Ortiz of the Executive Presidency of AyA, its annex 'INFORME' dated March 20, 2024, and its annexes 1 through 4, records 1, 2, and 3 of the Integrated Commercial System OPEN (SCI-OPEN), which are attached as documentary evidence to this Report, and scope of the rule regulated for this purpose in the Reglamento para la prestación de los servicios de AyA, Reglamento Técnico: Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes, AR-PSAYA-2015, Reglamento para la adquisición y administración de recursos informáticos de AyA, and Ley de Protección al ciudadano del exceso de requisitos y trámites administrativos, Ley N°8220, specifically: FIRST: It is true that the Palo Campano Urbanization, located behind the Liceo de Alajuelita, and the communities of San Josecito, Tejarcillos, and San Felipe, have a Human Development Park, however, the inauguration date of this is not on record in this office as it is a matter outside the competencies assigned to AyA in its Constitutive Law N°2726. (See memorandum No. SG-GSGAM-MZOESTE-2024-00363, dated March 20, 2024, and its annex 'INFORME RESPUESTA OFICIO 05032024', dated March 12, 2024.). SECOND: It is also outside AyA's competencies to verify if the Human Development Park located in San Josecito de Alajuelita presents any problem related to vandalism, theft of plastic garbage cans, destruction of areas where children play, damage in common areas for sharing, illegal dumping, garbage burning, drinking fountains without water, among others. However, it is reported that the Human Development Park is supplied by three drinking water services, specifically, NIS 5510719, 5543158, and 5549350, all are located on the public road and are billed in the name of MINISTERIO DE CULTURA Y JUVENTUD. (See memorandum No. SG-GSGAM-MZOESTE-2024-00363, dated March 20, 2024, and its annex 'INFORME RESPUESTA OFICIO 05032024', dated March 12, 2024.) The three services are active in the Integrated Commercial System OPEN (SCI-OPEN) and up to the limit of the public road with the Park, they are provided normally, it being the responsibility of the Park administrator to detail how the supply of the services is distributed internally within the same, whether in drinking fountains, sanitary services, among others. (See attached evidence Annex – SCI-OPEN Records) THIRD: Regarding this Institution, we are only aware of the complaint filed on March 04, 2024, by the Junta Directiva Palo Campano, whose subject indicated 'Oficio 05032024 - Solicitud de reparación de fuga Nuevo Parque de Desarrollo Humano y habilitación de bebederos públicos', which was sent to the email account [email protected] assigned to this Executive Presidency office, and regarding which it should be noted, does not correspond to an official means for receiving citizen complaints. (See memorandum PRE-2024-00256, dated March 20, 2024, and its annex 'INFORME' dated March 20, 2024). Likewise, the REGLAMENTO PARA LA ADQUISICIÓN Y ADMINISTRACIÓN DE RECURSOS INFORMÁTICOS DE AYA, states in Article 36 that email is a work tool to expedite and facilitate the procedures of each office, specifically: '(…) Uses of email. Email is a work tool to expedite and facilitate the procedures of each office. Its use is regulated by Directive of the Board of Directors. (….)'. In effect, it is reported that the attention of citizen complaints must be channeled through the official means assigned by AyA for this purpose, specifically: a) Line 800-7376783; b) Suggestion Box on the institution's website www.aya.go.cr, the latter assigned to the Contraloría de Servicios of AyA to receive complaints relating to the provision of the services provided by the institution - Link: https://www.aya.go.cr/contraloria/SitePages/buzonsugerencias.aspx FOURTH: The leak reported by the Junta Directiva Palo Campano through the email sent to this Executive Presidency office on March 04, 2024, is located inside the facilities of the Human Development Park of San Josecito de Alajuelita, therefore, it is up to the Park administrator to proceed with its repair in order to maintain the internal facilities necessary for the enjoyment of the services in good operating condition, as is imposed for this purpose in Article 7 of the Reglamento para la prestación de los servicios de AyA, published in the Official Gazette Digital La Gaceta N°27, Scope N°29, Tuesday, February 9, 2021. (See memorandum No. SG-GSGAM-MZOESTE-2024-00363, dated March 20, 2024, and its annex 'INFORME RESPUESTA OFICIO 05032024', dated March 12, 2024.) In the same sense, Articles 7 and 8 of the Aresep Technical Regulation 'Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes -AR-PSAYA-2015' published in Scope N°55 of La Gaceta N°69, dated April 12, 2016, state that the services provided by the Institution will be supplied up to the physical limit of the aqueduct service, specifically, the location of the water meter (hidrómetro) and its accessories, provided it is located outside the property, otherwise, it would be the property limit and in the case of the sewerage service, it will be at the outlet fitting of the siphon box (caja sifón), therefore, upon verifying that the leak is located inside the Human Development Park, it is outside AyA's competencies to proceed with its repair. FIFTH: The complaint filed on March 04, 2024, by the Junta Directiva Palo Campano, to the email account [email protected] and whose subject indicated 'Oficio 05032024 - Solicitud de reparación de fuga Nuevo Parque de Desarrollo Humano y habilitación de bebederos públicos', was forwarded by this office the following day for attention and resolution by the General Management and the GAM Systems Management Sub-Management, which was also notified to the complainant themselves on March 07, 2024. Furthermore, since March 06 and 07 of the current year, AyA maintained communication via email with the personnel of the Municipalidad de Alajuelita related to the leak complaint raised by the petitioner through administrative channels, which was also reported to the Junta Directiva Palo Campano itself. (See memorandum PRE-2024-00256, dated March 20, 2024, and its annex 'INFORME' dated March 20, 2024). A field inspection was also carried out which verified the existence of the leak inside the Human Development Park located in San Josecito de Alajuelita, and in effect, the responsibility of the Park administrator to proceed with its repair, the foregoing being communicated to the Junta Directiva Palo Campano through administrative channels by means of the 'INFORME RESPUESTA OFICIO 05032024', dated March 12, 2024, which also recommended filing the corresponding complaints before the MINISTERIO DE CULTURA Y JUVENTUD, as the subscriber for NIS 5510719, 5543158, and 5549350, so that it takes the appropriate actions since the water spilled from the leak is being reflected in the service invoice. (See memorandum No. SG-GSGAM-MZOESTE-2024-00363, dated March 20, 2024, and its annex 'INFORME RESPUESTA OFICIO 05032024', dated March 12, 2024.) In accordance with the foregoing, it is not true that AyA has failed to reach an agreement with the Municipalidad de Alajuelita to repair the drinking water leak reported in this specific case, since as already indicated, as a result of the actions deployed by AyA, it was verified that such repair corresponds to the Park administrator, given that up to the public road limit, AyA provides the drinking water service through three services approved for that purpose ...'. '... In the present case, it is evident that there has been no contempt by AyA of any constitutional precept, given that the request submitted by the Junta Directiva Palo Campano regarding the water leak in the Human Development Park, located in San Josecito, Alajuelita, was timely forwarded by this Executive Presidency Office to the areas in charge for its attention, even though it was sent to the email account [email protected] which does not correspond to an official means for receiving this type of complaint. Additionally, the area responsible for its attention resolved the complaint in accordance with the legal framework, which was duly communicated to the complainant themselves through administrative channels via the 'INFORME RESPUESTA OFICIO 05032024', dated March 12, 2024, which clarified that the reported leak and the drinking fountains are located within the Park, such that its repair is outside AyA's control, and it is recommended to refer the case to the Ministerio de Cultura y Juventud so it takes the appropriate actions, since the spilled water is being reflected in the service invoice.'. It requests that the appeal be dismissed.

4.- By a document incorporated into the digital file on March 22, 2024, Modesto Alpízar Luna reports under oath in his capacity as mayor of the Municipalidad de Alajuelita, who states the following: '... FIRST: the petitioner claims that several communities in Alajuelita have the Human Development Park; however. (sic) Indicates that the park presents a significant problem related to vandalism, theft of plastic garbage cans, destruction of children's areas and common areas for sharing, garbage, water leak, etc., he goes on to state that he proceeded to inform through the email [email protected] and in person to the vice-mayor about these issues without the situation having been resolved, in his view the most serious is the water problem, which affects the canton and the country, while the municipality and the Instituto Costarricense de Acueductos y Alcantarillados do not reach an agreement, since the former warns that it is beyond its jurisdiction, the latter does nothing to prevent thousands of liters of water from being lost daily. Therefore, he considers his fundamental rights violated. SECOND: in the first instance and in accordance with what was requested by this chamber, the email address: [email protected], belongs to the institutional email address assigned to Ms. Vice-Mayor Rosario Siles Fernández, however, IT IS NOT provided for as an official mechanism for receiving user procedures, for these purposes the following electronic addresses are available, which can be confirmed on the municipality's website: 1. [email protected], 2. [email protected], and 3. [email protected]. THIRD: in report MA-AM-GAMB-017-2024 dated March 20, 2024, issued by the head of Environmental Management, Licda. Johanna Ávila Vargas, it is indicated that on October 19, 2023, a tour was conducted of the Parque para el Desarrollo Humano de Alajuelita (PDHA) with the presence of Patricia Sandoval, Keyli Mena, Ronald Sánchez, Teresita Zúñiga, and Modesto Alpízar, mayor, where recycling bins located in the parking area were found, as well as the ranchos, unfortunately vandalized; for this reason, Environmental Management immediately repaired the four ranchos of the PDHA, reinforcing the bases with cement, to prevent the ranchos from falling and causing an accident, likewise, cleaning and collection of garbage outside the bins and throughout the park area was carried out, furthermore, it was arranged that twice a week, two collaborators enter the property collecting all the garbage and subsequently remove it from the park. FOURTH: on the other hand, in report MA-AM-PO-0030-2024 dated March 20, 2024, the head of Parks and Ornamentation, Architect Keyli Mena Alfaro, points out that in the last quarter of 2023, specifically in the month of October, Parques y Ornatos assumed responsibility for the maintenance of the PDHA, for the remainder of the year and with agreed pacts that there would be surveillance in the sector, due to several reports of theft and robberies in the sector. It is entered and the state of the Park is that it has quite abundant and tall grass, so work begins with the complete work crew of Parques y Ornato, in one week the park was already in perfect condition regarding the grass and shrubs. I detail the works that continue to be carried out. • Cutting of grass in green areas. • Cutting and control of elephant grass in stream setbacks (retiros de quebradas). • Recovery and pruning of shrubs planted on slopes and green areas. • Weeding, leaf removal, rounds and fertilizing of trees planted in the area. • Cleaning of gutters, catch basins and stormwater grates. The maintenance has been given to 8 hectares of space built and used by the residents of the communities. FIFTH: finally, in report MA-AM-PM-066-2024 dated March 21, 2024, rendered by Magister Johan Abarca Abarca, head of the Municipal Police, the actions of the police force are denoted, who have included this park within their daily operational tasks, within the canton preventive patrols and established routes are carried out, in these, various points of interest in the canton are visited, due to their possible criminal incidence, each point is visited in the morning, afternoon, and night, generally at times between 9:00 and 21:00 hours, according to the working hours of this department; one of these points is the Human Development Park, for which reason daily the park has a police presence at least 3 times. SIXTH: On the other hand, everything that has to do specifically with the supply of drinking water, administration, and operation of aqueduct and sewerage systems, corresponds by law to the Instituto Costarricense de Acueductos y Alcantarillados, whose competence is to direct everything related to the supply of drinking water and the collection and evacuation of sewage and residual water, which implies the possibility of establishing policies and issuing regulations on this matter. This is established by its Constitutive Law, number 2726 of April 14, 1976, in sections 1° and 2°, subsections a) and g) which provide: ARTICULO 1º.- Con el objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable y recolección y evacuación de aguas negras y residuos industriales líquidos, lo mismo que el aspecto normativo de los sistemas de alcantarillado pluvial en áreas urbanas, para todo el territorio nacional se crea el Instituto Costarricense de Acueductos y Alcantarillados, como institución autónoma del Estado.'. It requests that the appeal be dismissed.

5.- The legal prescriptions have been observed in the proceedings followed.

Drafted by Judge Hess Herrera; and,

Considerando:

I.- PURPOSE OF THE APPEAL. The petitioner states that the Urbanización Palo Campano, located behind the Liceo de Alajuelita, and the communities of San Josecito, Tejarcillos, and San Felipe have the Human Development Park, inaugurated on July 12, 2023. He indicates that the park presents a significant problem related to vandalism, theft of plastic garbage cans, destruction of areas where children play, damage in common areas for sharing, illegal dumping, garbage burning, drinking fountains without water, among others. He states that in recent days, he proceeded to inform via emails to the electronic address [email protected], and in person, the mayor of Alajuelita about these issues and, in addition, the water leak that exists in the Human Development Park which, at this moment, is the most serious matter. He alleges that neither the Instituto Costarricense de Acueductos y Alcantarillados nor the Municipalidad de Alajuelita have done anything regarding the complaints raised.

II.- PROVEN FACTS. Of importance for the decision in this matter, the following facts are deemed duly demonstrated:

Regarding the Instituto Costarricense de Acueductos y Alcantarillados:

• a)The petitioner is secretary of the Board of Directors of the Urbanización Palo Campano (uncontroverted fact).
• b)The Urbanización Palo Campano - located behind the Liceo de Alajuelita - and the communities of San Josecito, Tejarcillos, and San Felipe have the Human Development Park (uncontroverted fact).
• c)The Human Development Park is supplied by three drinking water services, specifically NIS 5510719, 5543158, and 5549350, all are located on the public road and are billed in the name of MINISTERIO DE CULTURA Y JUVENTUD (see report rendered under oath and attached evidence).
• d)The complaint raised by the petitioner on March 04, 2024, for repair of a water leak in the Human Development Park and enabling of public drinking fountains was sent to the email account [email protected] assigned to the Executive Presidency of the ICAA; however, it does not correspond to an official means for receiving citizen complaints (see report rendered under oath and attached evidence).
• e)The ICAA received the complaint filed by the petitioner, being assigned 'Oficio 05032024. Solicitud de reparación de fuga Nuevo Parque de Desarrollo Humano y habilitación de bebederos públicos', which was forwarded the following day for attention and resolution by the General Management and the GAM Systems Management Sub-Management. Likewise, it was notified to the complainant themselves on March 07, 2024. Furthermore, since March 06 and 07, 2024, the ICAA maintained communication via email with the personnel of the Municipalidad de Alajuelita due to the leak complaint raised by the petitioner, about which the Junta Directiva Palo Campano itself was also informed (see report rendered under oath and attached evidence).
• f)Through the report 'RESPUESTA OFICIO 05032024' dated March 12, 2024, it is verified that the ICAA proceeded to carry out a field inspection that allowed verifying the existence of the leak inside the Human Development Park located in San Josecito de Alajuelita and, in effect, the responsibility of the park administrator to proceed with its repair, which was communicated to the Junta Directiva Palo Campano, recommending the filing of the respective complaint of the case before the MINISTERIO DE CULTURA Y JUVENTUD -as subscriber- so that the necessary actions are taken, since the water spilled due to the leak is being reflected in the billing of the service provided (see report rendered under oath and attached evidence).

Regarding the Municipalidad de Alajuelita:

• a)On March 04, 2024, the petitioner sent his complaint to the email [email protected] – assigned to the vice-mayor of the Municipalidad de Alajuelita -; however, it is not provided for as an official mechanism for receiving user procedures. For these purposes, the following electronic addresses are available: [email protected], [email protected], and [email protected] (see report rendered under oath and attached evidence).
• b)In report MA-AM-GAMB-017-2024 dated March 20, 2024, issued by the head of Environmental Management, Licda. Johanna Ávila Vargas, the following was stated: '... on October 19, 2023, a tour was conducted of the Parque para el Desarrollo Humano de Alajuelita (PDHA) with the presence of Patricia Sandoval, Keyli Mena, Ronald Sánchez, Teresita Zúñiga, and Modesto Alpízar, mayor, where recycling bins located in the parking area were found, as well as the ranchos, unfortunately vandalized; for this reason, Environmental Management immediately repaired the four ranchos of the PDHA, reinforcing the bases with cement, to prevent the ranchos from falling and causing an accident, likewise, cleaning and collection of garbage outside the bins and throughout the park area was carried out, furthermore, it was arranged that twice a week, two collaborators enter the property collecting all the garbage and subsequently remove it from the park ...' (see report rendered under oath and attached evidence).
• c)Through report MA-AM-PO-0030-2024 dated March 20, 2024, the head of Parks and Ornamentation, Architect Keyli Mena Alfaro, stated the following: '... that in the last quarter of 2023, specifically in the month of October, Parques y Ornatos assumed responsibility for the maintenance of the PDHA, for the remainder of the year and with agreed pacts that there would be surveillance in the sector, due to several reports of theft and robberies in the sector. It is entered and the state of the Park is that it has quite abundant and tall grass, so work begins with the complete work crew of Parques y Ornato, in one week the park was already in perfect condition regarding the grass and shrubs. I detail the works that continue to be carried out. • Cutting of grass in green areas. • Cutting and control of elephant grass in stream setbacks. • Recovery and pruning of shrubs planted on slopes and green areas. • Weeding, leaf removal, rounds and fertilizing of trees planted in the area. • Cleaning of gutters, catch basins and stormwater grates. • d)Through report MA-AM-PM-066-2024 dated March 21, 2024, rendered by Johan Abarca Abarca, head of the Municipal Police, the following was asserted: '... the actions of the police force are denoted, who have included this park within their daily operational tasks, within the canton preventive patrols and established routes are carried out, in these, various points of interest in the canton are visited, due to their possible criminal incidence, each point is visited in the morning, afternoon, and night, generally at times between 9:00 and 21:00 hours, according to the working hours of this department; one of these points is the Human Development Park, for which reason daily the park has a police presence at least 3 times ...' (see report rendered under oath and attached evidence).

III.- ON THE SPECIFIC CASE. According to the sub examine, it has been demonstrated that the petitioner is secretary of the Board of Directors of the Urbanización Palo Campano. Likewise, it is verified that the Urbanización Palo Campano - located behind the Liceo de Alajuelita - and the communities of San Josecito, Tejarcillos, and San Felipe have the Human Development Park. On the other hand, it is confirmed that the Human Development Park is supplied by three drinking water services, specifically NIS 5510719, 5543158, and 5549350, all are located on the public road and are billed in the name of MINISTERIO DE CULTURA Y JUVENTUD. In addition to this, it is corroborated that the complaint raised by the petitioner on March 04, 2024, for the repair of a water leak in the Human Development Park and the enabling of public drinking fountains was sent to the email account [email protected] assigned to the Executive Presidency of the ICAA; however, it does not correspond to an official means for receiving citizen complaints. Furthermore, it is verified that the ICAA received the complaint filed by the petitioner, being assigned oficio 05032024 'Solicitud de reparación de fuga Nuevo Parque de Desarrollo Humano y habilitación de bebederos públicos', which was forwarded the following day for attention and resolution by the General Management and the GAM Systems Management Sub-Management. Likewise, it was notified to the complainant themselves on March 07, 2024. Furthermore, since March 06 and 07, 2024, the ICAA maintained communication via email with the personnel of the Municipalidad de Alajuelita due to the leak complaint raised by the petitioner, about which the Junta Directiva Palo Campano itself was also informed. In addition, through the report 'RESPUESTA OFICIO 05032024' dated March 12, 2024, it is verified that the ICAA proceeded to carry out a field inspection that allowed verifying the existence of the leak inside the Human Development Park located in San Josecito de Alajuelita and, in effect, the responsibility of the park administrator to proceed with its repair, which was communicated to the Junta Directiva Palo Campano, recommending the filing of the respective complaint of the case before the MINISTERIO DE CULTURA Y JUVENTUD -as subscriber- so that the necessary actions are taken, since the water spilled due to the leak is being reflected in the billing of the service provided.

On the other hand, it is verified that on March 04, 2024, the petitioner sent his complaint to the email [email protected] – assigned to the vice-mayor of the Municipalidad de Alajuelita -; however, it is not provided for as an official mechanism for receiving user procedures. For these purposes, the following electronic addresses are available: [email protected], [email protected], and [email protected]. Now then, in report MA-AM-GAMB-017-2024 dated March 20, 2024, issued by the head of Environmental Management, Licda. Johanna Ávila Vargas, the following was stated: "...

On October 19, 2023, a site visit was conducted at the Parque para el Desarrollo Humano de Alajuelita (PDHA) with the presence of Patricia Sandoval, Keyli Mena, Ronald Sánchez, Teresita Zúñiga, and Modesto Alpízar, mayor, where recycling bins located in the parking area were found, as well as the shelters (ranchos), unfortunately vandalized; for this reason, Gestión Ambiental immediately repaired the four shelters of the PDHA, reinforcing the bases with cement to prevent the shelters from falling and causing an accident; likewise, cleaning and collection of garbage outside the bins and throughout the park area was carried out; furthermore, it was arranged that three times a week, two collaborators enter the property collecting all the garbage, which is subsequently removed from the park...”. Additionally, through report MA-AM-PO-0030-2024 dated March 20, 2024, the head of Parques y Ornato, Architect Keyli Mena Alfaro, stated the following: “... that in the last quarter of 2023, specifically in the month of October, Parques y Ornatos assumed responsibility for the maintenance of the PDHA, for the remainder of the year and with agreed arrangements that there would be surveillance in the sector, due to several reports of theft and robberies in the sector. We entered, and the state of the Park was that it had quite abundant and tall grass, so work began with the full Parques y Ornato crew; within a week, the park was in perfect condition regarding the grass and shrubs. I detail the work that continues to be carried out. • Grass cutting in green areas. • Cutting and control of elephant grass in stream setbacks (retiros de quebradas). • Recovery and pruning of shrubs planted on slopes and green areas. • Weeding, leaf removal, clearing (rondas), and fertilizing of trees planted in the area. • Cleaning of gutters, manholes (cajas de registro), and storm drains (tragantes de aguas pluviales). Maintenance has been provided to 8 hectares of space built and used by the residents of the communities...”. In turn, through report MA-AM-PM-066-2024 dated March 21, 2024, rendered by Johan Abarca Abarca, head of the Municipal Police (Policía Municipal), the following was asserted: “... the actions of the police force are noted, who have this park included within their daily operational duties; within the canton, preventive patrols and established routes are carried out, in which various points of interest in the canton are visited, due to their potential for criminal activity; each point is visited in the morning, afternoon, and night, generally between the hours of 9:00 a.m. and 9:00 p.m., according to the working hours of this department; one of these points is the Parque de Desarrollo Humano, therefore, the park has a police presence at least 3 times daily...”.

IV.- It is important to note, first of all, that it cannot be proven that the management whose lack of attention is alleged in the case under study was raised before the ICAA and the Municipality of Alajuelita (Municipalidad de Alajuelita) through the official channels established for receiving communications. Therefore, this Chamber does not find proven injury to the fundamental rights of the protected party in the terms in which the appeal (recurso) was formulated, since in the sub iudice there is no evidence that the respondent authorities received the email dated March 4, 2024, through an official means for submitting requests.

Secondly, as verified from the body of evidence, both institutions addressed the respective complaints. In the case of the ICAA, it is clear in its report that, by indicating that the Parque de Desarrollo Humano is supplied by three drinking water services—NIS 5510719, 5543158, and 5549350—all located on public roads and billed in the name of the MINISTERIO DE CULTURA Y JUVENTUD, it is this ministerial department that is responsible—as established by current regulations—to solve the water leak problem.

By virtue of the foregoing, it is evident that there has been no contempt (desacato) by the ICAA, nor by the appealed local government, of any constitutional precept, given that the request filed by the Junta Directiva Palo Campano regarding the water leak in the Parque de Desarrollo Humano and the acts of vandalism committed against said park were addressed by both institutions, all of which was duly communicated to the complainant himself.

V.- CONCLUSION. Consequently, since no arbitrary act has been demonstrated under the conditions alleged by the appellant, what is appropriate is to declare the appeal without merit (sin lugar el recurso) in all its aspects, as is hereby ordered.

VI.- DOCUMENTATION PROVIDED TO THE FILE. The parties are warned that if they have provided any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or produced by new technologies, these must be removed from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not removed within this period will be destroyed, in accordance with the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in session N° 27-11 of August 22, 2011, article XXVI and published in the Boletín Judicial number 19 of January 26, 2012, as well as in the agreement approved by the Consejo Superior del Poder Judicial, in session N° 43-12 held on May 3, 2012, article LXXXI.

Por tanto:

Sala Constitucional Clase de asunto: Recurso de amparo Analizado por: SALA CONSTITUCIONAL  Res. Nº 2024009584 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del doce de abril de dos mil veinticuatro .

Recurso de amparo que se tramita en el expediente No. 24-006886-0007-CO, interpuesto por FREDDY JAVIER FLORES BUSTOS, cédula de identidad 0109980731, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS y la MUNICIPALIDAD DE ALAJUELITA.

Resultando:

1.- Por escrito agregado al Sistema Costarricense de Gestión de Despachos Judiciales de esta Sala el 13 de marzo de 2024, el recurrente presenta recurso de amparo en contra del Instituto Costarricense de Acueductos y Alcantarillados y la Municipalidad de Alajuelita. Manifiesta que la Urbanización Palo Campano, ubicada detrás del Liceo de Alajuelita, y las comunidades de San Josecito, Tejarcillos, y San Felipe, cuentan con el Parque de Desarrollo Humano, inaugurado el 12 de julio de 2023, hace menos de un año -https://www.mcj.go.cr/sala-de-prensa/noticias/parque-para-el-desarrollo-humano-de-alajuelita-se-inaugura-este-viernes-. Indica que el parque presenta una problemática importante relacionada a vandalismos, robo de basureros plásticos, destrucción de áreas donde juegan los niños, destrozos en las áreas comunes para compartir, tiradero de basura, quemas de basura, bebederos sin agua, entre otros. Manifiesta que en días pasados, procedió a informar mediante correos electrónicos a la dirección electrónica [email protected], y en persona, a la alcaldesa de Alajuelita sobre estos temas y además, de la fuga de agua que hay en el Parque de Desarrollo Humano que, en este momento es lo más grave, pero no se ha hecho nada a pesar de que según el Instituto Costarricense de Acueductos y Alcantarillados es competencia de la Municipalidad de Alajuelita hacer los arreglos de esa fuga. Narra que podría llenar de fuentes documentales este recurso al exponer la problemática del agua, ya que, no sólo se generaliza en el país, sino también las comunidades cercanas se ven afectadas por el faltante de agua, al no llenarse los tanques que abastecen la zona. Agrega que lamentablemente los correos van y vienen sin que se ponga de acuerdo el Instituto Costarricense de Acueductos y Alcantarillados con la Municipalidad de Alajuelita, pues el instituto recurrido indica que no les corresponde a ellos arreglar la fuga por estar fuera de su competencia y la municipalidad no hace nada para evitar que miles de litros de agua que se estén perdiendo diariamente, desde hace más de dos meses, generando así la disminución del abasto de agua en todo el cantón. Estima que tal actuación resulta violatoria de sus derechos fundamentales.

2.- Por resolución de Presidencia de las 10:24 horas del 15 de marzo de 2024, se le dio curso al presente amparo.

3.- Por escrito incorporado al expediente digital el 21 de marzo de 2024, informa bajo juramento Juan Manuel Quesada Espinoza en su condición de presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, quien manifiesta lo siguiente: “… Vistos los alegatos del recurrente, se procede a rendir el presente Informe con base al contenido del memorando No.SG-GSGAM-MZOESTE-2024-00363, suscrito en fecha 20 de marzo del 2024 por el Ing. Iván Paniagua Arias de la Macro Zona Oeste GAM de AyA, y su anexo “INFORME RESPUESTA OFICIO 05032024”, de fecha 12 de marzo de 2024, memorando PRE-2024-00256, suscrito en fecha 20 de marzo de 2024, por la Licda. Brenda Soto Ortiz de la Presidencia Ejecutiva de AyA, su anexo “INFORME” de fecha 20 de marzo de 2024 y sus anexos 1 al 4, registros 1, 2 y 3 del Sistema Comercial Integrado OPEN (SCI-OPEN), los cuales se adjuntan como prueba documental de este Informe, y alcance de la norma que al efecto se regula en el Reglamento para la prestación de los servicios de AyA, Reglamento Técnico: Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes, AR-PSAYA-2015, Reglamento para la adquisición y administración de recursos informáticos de AyA y Ley de Protección al ciudadano del exceso de requisitos y trámites administrativos, Ley N°8220, específicamente: PRIMERO: Es cierto que la Urbanización Palo Campano, ubicada detrás del Liceo de Alajuelita, y las comunidades de San Josecito, Tejarcillos, y San Felipe, cuentan con un Parque de Desarrollo Humano, sin embargo, no consta a este despacho la fecha inauguración de este pues es un asunto ajeno a las competencias asignadas a AyA en su Ley Constitutiva N°2726. (Ver memorando No. SG-GSGAM-MZOESTE-2024-00363, de fecha 20 de marzo del 2024 y su anexo “INFORME RESPUESTA OFICIO 05032024”, de fecha 12 de marzo de 2024.). SEGUNDO: También es ajeno a las competencias de AyA verificar si el Parque de Desarrollo Humano ubicado en San Josecito de Alajuelita presente alguna problemática relacionada a vandalismos, robo de basureros plásticos, destrucción de áreas donde juegan los niños, destrozos en las áreas comunes para compartir, tiradero de basura, quemas de basura, bebederos sin agua, entre otros. Sin embargo, se informa que el Parque de Desarrollo Humano se abastece de tres servicios de agua potable, específicamente, NIS 5510719, 5543158 y 5549350, todos están ubicados en la vía pública y se facturan a nombre del MINISTERIO DE CULTURA Y JUVENTUD. (Ver memorando No. SG-GSGAM-MZOESTE-2024-00363, de fecha 20 de marzo del 2024 y su anexo “INFORME RESPUESTA OFICIO 05032024”, de fecha 12 de marzo de 2024.) Los tres servicios se encuentran activos en el Sistema Comercial Integrado OPEN (SCI-OPEN) y al límite de la vía pública con el Parque, se brindan, con normalidad, siendo competencia del administrador del Parque detallar la forma en que se distribuye el abastecimiento de los servicios a lo interno del mismo, sea en bebederos, servicios sanitarios, entre otros. (Ver Anexo de prueba adjunto – Registros del SCI-OPEN) TERCERO: En lo que respecta a esta Institución, únicamente nos consta la denuncia presentada en fecha 04 de marzo del 2024 por la Junta Directiva Palo Campano, cuyo asunto indicó “Oficio 05032024 - Solicitud de reparación de fuga Nuevo Parque de Desarrollo Humano y habilitación de bebederos públicos”, la cual fue remitida a la cuenta de correo electrónico [email protected] asignada a este despacho de Presidencia Ejecutiva, y de la cual cabe informar, no corresponde a un medio oficial para recibir denuncias de los ciudadanos. (Ver memorando PRE-2024-00256, de fecha 20 de marzo de 2024, y su anexo “INFORME” de fecha 20 de marzo de 2024). De igual, el REGLAMENTO PARA LA ADQUISICIÓN Y ADMINISTRACIÓN DE RECURSOS INFORMÁTICOS DE AYA, expone en el artículo 36 que el correo electrónico es una herramienta de trabajo para agilizar y facilitar las gestiones de cada oficina, específicamente: “(…) Usos del correo electrónico. El correo electrónico es una herramienta de trabajo para agilizar y facilitar las gestiones de cada oficina. Su uso se encuentra regulado por Directriz de Junta Directiva. (….)”. En su efecto, se informa que la atención de denuncias de los ciudadanos se debe canalizar a través de los medios oficiales asignados por AyA al efecto, específicamente: a) Línea 800- 7376783; b) Buzón de Sugerencia de la página web de la institución www.aya.go.cr, este último asignado a la Contraloría de Servicios de AyA para recibir denuncias relativas a la prestación de los servicios que brinda la institución - Enlace: https://www.aya.go.cr/contraloria/SitePages/buzonsugerencias.aspx CUARTO: La fuga denunciada por la Junta Directiva Palo Campano por medio del correo electrónico remitido a este despacho de Presidencia Ejecutiva en fecha 04 de marzo del 2024, se ubica a lo interno de las instalaciones del Parque de Desarrollo Humano de San Josecito de Alajuelita, por lo que corresponde al administrador del Parque proceder con la reparación de la misma con el fin de mantener en buen estado de funcionamiento las instalaciones internas necesarias para el disfrute de los servicios, tal y como al efecto se impone en el artículo 7 del Reglamento para la prestación de los servicios de AyA, publicado en el Diario Oficial La Gaceta Digital N°27, Alcance N°29, martes 09 de febrero, 2021. (Ver memorando No.SG-GSGAM-MZOESTE-2024-00363, de fecha 20 de marzo del 2024 y su anexo “INFORME RESPUESTA OFICIO 05032024”, de fecha 12 de marzo de 2024.) En el mismo sentido, los artículos 7 y 8 del Reglamento Técnico de Aresep “ Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes -AR-PSAYA-2015” publicado en el Alcance N°55 de La Gaceta N°69, del 12 de abril de 04-2016, exponen que los servicios que brinda la Institución serán suministrados hasta el límite físico del servicio de acueducto, específicamente, la ubicación del hidrómetro y sus accesorios, siempre y cuando éste se encuentre fuera de la propiedad, caso contrario, sería el límite de la propiedad y en el caso del servicio del servicio de alcantarillado será en el accesorio de salida de la caja sifón, por lo que, al comprobarse que la fuga se ubica a lo interno del Parque de Desarrollo Humano, es ajeno a las competencias de AyA proceder con la reparación de la misma. QUINTO: La denuncia presentada en fecha 04 de marzo del 2024 por la Junta Directiva Palo Campano, a la cuenta de correo electrónico [email protected] y cuyo asunto indicó “Oficio 05032024 - Solicitud de reparación de fuga Nuevo Parque de Desarrollo Humano y habilitación de bebederos públicos”, fue trasladada por este despacho al día siguiente para atención y resolución de la Gerencia General y Subgerencia Gestión de Sistemas GAM, lo cual además fue notificado al propio denunciante en fecha 07 de marzo de 2024. Además, desde los días 06 y 07 de marzo del año en curso, AyA mantuvo comunicación vía correo electrónico con el personal de la Municipalidad de Alajuelita relacionada a la denuncia de fuga planteada por la recurrente en vía administrativa, lo cual también era informado a la propia Junta Directiva Palo Campano. (Ver memorando PRE-2024-00256, de fecha 20 de marzo de 2024, y su anexo “INFORME” de fecha 20 de marzo de 2024). También se procedió a ejecutar la inspección de campo que permitió verificar la existencia de la fuga a lo interno del Parque de Desarrollo Humano ubicado en San Josecito de Alajuelita, y en su efecto, la responsabilidad del administrador del Parque para proceder con la reparación de la misma, siendo lo anterior comunicado a la Junta Directiva Palo Campano en vía administrativa mediante el INFORME “RESPUESTA OFICIO 05032024”, de fecha 12 de marzo de 2024, el cual además, recomendó interponer las denuncias del caso ante el MINISTERIO DE CULTURA Y JUVENTUD, en calidad de abonado de los NIS 5510719, 5543158 y 5549350, de forma que este tome las acciones correspondientes ya que el agua derramada en la fuga se está viendo reflejada en la factura de los servicios. (Ver memorando No.SG-GSGAM-MZOESTE-2024-00363, de fecha 20 de marzo del 2024 y su anexo “INFORME RESPUESTA OFICIO 05032024”, de fecha 12 de marzo de 2024.) De acuerdo con lo anterior, no es cierto que AyA no se haya puesto de acuerdo con la Municipalidad de Alajuelita, para reparar la fuga de agua potable que se denuncia en este caso concreto, pues tal y como ya se indicó, como resultado de las acciones desplegadas por AyA, se logró verificar que tal reparación corresponde al administrador del Parque, siendo que al límite de la vía pública AyA brinda la prestación del servicio de agua potable a través de tres servicios aprobados al efecto ...”. “... En el presente caso se evidencia que no ha existido un desacato de AyA a algún precepto constitucional, siendo que la gestión presentada por la Junta Directiva Palo Campano con respecto a la fuga de agua en el parque de Desarrollo Humano, ubicado en San Josecito, Alajuelita, fue trasladada oportunamente por este Despacho de la Presidencia Ejecutiva a las áreas encargadas para su atención, aún y cuando la misma fue remitida a la cuenta de correo electrónico [email protected] que no corresponde a un medio oficial para recibir este tipo de denuncias. Adicionalmente, el área encargada de su atención resolvió la denuncia conforme el bloque de legalidad, lo cual fue debidamente comunicado al propio denunciante en vía administrativa a través del “INFORME RESPUESTA OFICIO 05032024”, de fecha 12 de marzo de 2024, el cual aclaró que la fuga reportada como los bebederos se encuentran dentro del Parque, de forma que la reparación de la misma está fuera del control del AyA, y se recomienda trasladar el caso al Ministerio de Cultura y Juventud para que tome las acciones correspondientes ya que el agua derramada se está viendo reflejada en la factura de los servicios.”. Solicita que se declare sin lugar el recurso.

4.- Por escrito incorporado al expediente digital el 22 de marzo de 2024, informa bajo juramento Modesto Alpízar Luna en su condición de alcalde de la Municipalidad de Alajuelita, quien señala lo siguiente: “... PRIMERO: acusa el recurrente que varias comunidades de Alajuelita cuentan con el Parque de Desarrollo Humano; sin embargo. (sic) Indica que el parque presenta una problemática importante relacionada al vandalismo, robo de basureros plásticos, destrucción de áreas infantiles y áreas comunes para compartir, basura, fuga de agua, etc, sigue señalando que procedió a informar mediante el correo [email protected] y en persona a la vice alcaldesa sobre estos temas sin que se haya solucionado la situación, a su criterio lo más grave es la problemática del agua, que afecta al cantón y al país, mientras el municipio y el Instituto Costarricense de acueductos y alcantarillados no se ponen de acuerdo, ya que el primero advierte que se escapa de su competencia, el segundo no hace nada para evitar que se pierdan miles de litros de agua diariamente. Por lo cual, considera lesionados sus derechos fundamentales. SEGUNDO: en primera instancia y de conformidad a lo solicitado por ésta sala, la dirección de correo electrónica: [email protected], pertenece a la dirección de correo institucional designado a la señora Vice alcaldesa Rosario Siles Fernández, empero, el mismo NO está previsto como mecanismo oficial para la recepción de gestiones de los usuarios, a esos efectos se tienen las siguientes direcciones electrónicas , que pueden ser ratificadas en la página web del municipio: 1. [email protected], 2. [email protected], y 3. [email protected]. TERCERO: en el informe MA-AM-GAMB-017-2024 de fecha 20 de marzo 2024, emitido por la encargada de Gestión ambiental, Licda. Johanna Ávila Vargas, se indica que el día 19 de octubre del 2023, se realizó una gira al Parque para el Desarrollo Humano de Alajuelita (PDHA) con la presencia de Patricia Sandoval, Keyli Mena, Ronald Sánchez, Teresita Zúñiga y Modesto Alpízar, alcalde, donde se encontraron basureros de reciclaje ubicados en la zona de parqueo, así como los ranchos ,lamentablemente vandalizados; razón por la cual, Gestión Ambiental, reparó de forma inmediata los cuatro ranchos del PDHA, dando reforzamiento a las bases con cemento, para evitar que los ranchos se cayeran y ocasionaran algún accidente, de igual forma, se realizó la limpieza y recolección de la basura fuera de los basureros y en toda la zona del parque, además, se dispuso, que tres veces por semana ingresen dos colaboradores al inmueble recolectando toda la basura y posteriormente se retira del parque. CUARTO: por otra parte, en el informe MA-AM-PO-0030-2024 de fecha 20 de marzo del 2024, la encargada de Parques y ornato, Arquitecta Keyli Mena Alfaro, señala que en el último trimestre del 2023, con exactitud en el mes de octubre Parques y Ornatos asume la responsabilidad del mantenimiento del PDHA, por lo que resta del año y con acuerdos pactados de que existiría vigilancia en el sector, debido a varias denuncias de hurto y robos en el sector. Se ingresa y el estado del Parque es que mantiene un césped bastante abundante y alto, por lo que se inicia con la cuadrilla completa de Parques y Ornato, en una semana ya se tenía el parque en perfecto estado con respecto al césped y los arbustos. Detallo los trabajos que se continúan realizando. • Corta de zacate en áreas verdes. • Corta y control de zacate elefante en retiros de quebradas. • Recuperación y poda de arbustos sembrados en laderas y zonas verdes. • Deshierbe, deshoje, rondas y abonado de árboles sembrados en la zona. • Limpieza de caños, cajas de registro y tragantes de aguas pluviales. El mantenimiento se le ha dado a 8 hectáreas de espacio construido y utilizado por los residentes de las comunidades. QUINTO: finalmente, en el informe MA-AM-PM-066-2024 de fecha 21 de marzo 2024, rendido por el Magister Johan Abarca Abarca, encargado de la Policía municipal, se denota la actuación del cuerpo policial, quienes tienen incluido este parque dentro de sus labores operativas diarias, dentro del cantón se realizan recorridos preventivos y rutas establecidas, en estas, se visitan diversos puntos de interés del cantón, por su posible incidencia delictiva, cada punto se visita en la mañana, tarde y noche, generalmente en horarios entre las 9:00 y las 21:00 horas, según las jornadas laborales de este departamento; uno de estos puntos es el Parque de Desarrollo Humano, por lo cual diariamente el parque cuenta con presencia policial mínimo 3 veces . SEXTO: Por otra parte, todo aquello que tiene que ver específicamente con el suministro de agua potable, administración y operación de los sistemas de acueductos y alcantarillados, le corresponde por ley al Instituto Costarricense de Acueductos y Alcantarillados, cuya competencia es dirigir todo lo relacionado con el suministro de agua potable y recolección y evacuación de aguas negras y residuales, lo cual supone la posibilidad de establecer políticas y dictar normativa en esa materia. Así lo establece su Ley Constitutiva, número 2726 de 14 de abril de 1976, en los numerales 1° y 2°, incisos a) y g) que disponen: ARTICULO 1º.- Con el objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable y recolección y evacuación de aguas negras y residuos industriales líquidos, lo mismo que el aspecto normativo de los sistemas de alcantarillado pluvial en áreas urbanas, para todo el territorio nacional se crea el Instituto Costarricense de Acueductos y Alcantarillados, como institución autónoma del Estado.”. Solicita que se declare sin lugar el recurso.

5.- En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Hess Herrera; y,

Considerando:

I.- OBJETO DEL RECURSO. EL recurrente manifiesta que la Urbanización Palo Campano, ubicada detrás del Liceo de Alajuelita y las comunidades de San Josecito, Tejarcillos, y San Felipe cuentan con el Parque de Desarrollo Humano, inaugurado el 12 de julio de 2023. Indica que el parque presenta una problemática importante relacionada a vandalismos, robo de basureros plásticos, destrucción de áreas donde juegan los niños, destrozos en las áreas comunes para compartir, tiradero de basura, quemas de basura, bebederos sin agua, entre otros. Manifiesta que en días pasados, procedió a informar mediante correos electrónicos a la dirección electrónica [email protected], y en persona, a la alcaldesa de Alajuelita sobre estos temas y además, de la fuga de agua que hay en el Parque de Desarrollo Humano que, en este momento es lo más grave. Alega que tanto el Instituto Costarricense de Acueductos y Alcantarillados como la Municipalidad de Alajuelita no han hecho nada frente a las denuncias planteadas.

II.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

En cuanto al Instituto Costarricense de Acueductos y Alcantarillados:

• a)El recurrentes es secretario de la Junta Directiva de la Urbanización Palo Campano (hecho incontrovertido).
• b)La Urbanización Palo Campano -ubicada detrás del Liceo de Alajuelita- y las comunidades de San Josecito, Tejarcillos y San Felipe cuentan con el Parque de Desarrollo Humano (hecho incontrovertido).
• c)El Parque de Desarrollo Humano se abastece de tres servicios de agua potable, específicamente NIS 5510719, 5543158 y 5549350, todos están ubicados en la vía pública y se facturan a nombre del MINISTERIO DE CULTURA Y JUVENTUD (ver informe rendido bajo juramento y prueba adjunta).
• d)La denuncia planteada por el recurrente el 04 de marzo de 2024, para reparación de fuga de agua en el Parque de Desarrollo Humano y habilitación de bebederos públicos fue remitida a la cuenta de correo electrónico [email protected] asignada a la Presidencia Ejecutiva del ICAA; sin embargo, no corresponde a un medio oficial para recibir denuncias de los ciudadanos (ver informe rendido bajo juramento y prueba adjunta).
• e)El ICCA recibió la denuncia presentada por el accionante, asignándosele el “Oficio 05032024. Solicitud de reparación de fuga Nuevo Parque de Desarrollo Humano y habilitación de bebederos públicos”, la cual fue trasladada al día siguiente para atención y resolución de la Gerencia General y Subgerencia Gestión de Sistemas GAM. Asimismo, fue notificado al propio denunciante en fecha 07 de marzo de 2024. Además, desde los días 06 y 07 de marzo de 2024, el ICAA mantuvo comunicación vía correo electrónico con el personal de la Municipalidad de Alajuelita debido a la denuncia de fuga planteada por el recurrente, de lo cual también se informó a la propia Junta Directiva Palo Campano (ver informe rendido bajo juramento y prueba adjunta).
• f)Mediante el informe “RESPUESTA OFICIO 05032024” de fecha 12 de marzo de 2024, se constata que el ICAA procedió a ejecutar la inspección de campo que permitió verificar la existencia de la fuga a lo interno del Parque de Desarrollo Humano ubicado en San Josecito de Alajuelita y en su efecto, la responsabilidad del administrador del parque para proceder con la reparación de la misma, lo cual fue comunicado a la Junta Directiva Palo Campano, recomendándose la interposición de la respectiva denuncia del caso ante el MINISTERIO DE CULTURA Y JUVENTUD -como abonado- para que se tomen las acciones necesarias, pues el agua derramada a causa de la fuga se está viendo reflejada en la facturación del servicio brindado (ver informe rendido bajo juramento y prueba adjunta).

En cuanto a la Municipalidad de Alajuelita:

• a)El 04 de marzo de 2024, el accionante envió su denuncia al correo [email protected] –asignado a la vice alcaldesa de la Municipalidad de Alajuelita-; sin embargo, no está previsto como mecanismo oficial para la recepción de gestiones de los usuarios. Para esos efectos se tienen las siguientes direcciones electrónicas: [email protected], [email protected] y [email protected] (ver informe rendido bajo juramento y prueba adjunta).
• b)En el informe MA-AM-GAMB-017-2024 de fecha 20 de marzo de 2024, emitido por la encargada de Gestión Ambiental, Licda. Johanna Ávila Vargas se indicó lo siguiente: “... día 19 de octubre del 2023, se realizó una gira al Parque para el Desarrollo Humano de Alajuelita (PDHA) con la presencia de Patricia Sandoval, Keyli Mena, Ronald Sánchez, Teresita Zúñiga y Modesto Alpízar, alcalde, donde se encontraron basureros de reciclaje ubicados en la zona de parqueo, así como los ranchos ,lamentablemente vandalizados; razón por la cual , Gestión Ambiental, reparó de forma inmediata los cuatro ranchos del PDHA, dando reforzamiento a las bases con cemento, para evitar que los ranchos se cayeran y ocasionaran algún accidente, de igual forma, se realizó la limpieza y recolección de la basura fuera de los basureros y en toda la zona del parque, además, se dispuso, que tres veces por semana ingresen dos colaboradores al inmueble recolectando toda la basura y posteriormente se retira del parque ...” (ver informe rendido bajo juramento y prueba adjunta).
• c)Mediante el informe MA-AM-PO-0030-2024 de fecha 20 de marzo de 2024, la encargada de Parques y Ornato, Arquitecta Keyli Mena Alfaro señaló siguiente: “... que en el último trimestre del 2023, con exactitud en el mes de octubre Parques y Ornatos asume la responsabilidad del mantenimiento del PDHA, por lo que resta del año y con acuerdos pactados de que existiría vigilancia en el sector, debido a varias denuncias de hurto y robos en el sector. Se ingresa y el estado del Parque es que mantiene un césped bastante abundante y alto, por lo que se inicia con la cuadrilla completa de Parques y Ornato, en una semana ya se tenía el parque en perfecto estado con respecto al césped y los arbustos. Detallo los trabajos que se continúan realizando. • Corta de zacate en áreas verdes. • Corta y control de zacate elefante en retiros de quebradas. • Recuperación y poda de arbustos sembrados en laderas y zonas verdes. • Deshierbe, deshoje, rondas y abonado de árboles sembrados en la zona. • Limpieza de caños, cajas de registro y tragantes de aguas pluviales. El mantenimiento se le ha dado a 8 hectáreas de espacio construido y utilizado por los residentes de las comunidades ...”. (ver informe rendido bajo juramento y prueba adjunta).
• d)A través del informe MA-AM-PM-066-2024 de fecha 21 de marzo de 2024, rendido por Johan Abarca Abarca, encargado de la Policía Municipal, se aseveró lo siguiente: “... se denota la actuación del cuerpo policial, quienes tienen incluido este parque dentro de sus labores operativas diarias, dentro del cantón se realizan recorridos preventivos y rutas establecidas, en estas, se visitan diversos puntos de interés del cantón, por su posible incidencia delictiva, cada punto se visita en la mañana, tarde y noche, generalmente en horarios entre las 9:00 y las 21:00 horas, según las jornadas laborales de este departamento; uno de estos puntos es el Parque de Desarrollo Humano, por lo cual diariamente el parque cuenta con presencia policial mínimo 3 veces ...” (ver informe rendido bajo juramento y prueba adjunta).

III.- SOBRE EL CASO CONCRETO. Según el sub examine, se tiene por demostrado que el recurrentes es secretario de la Junta Directiva de la Urbanización Palo Campano. Asimismo, se constata que la Urbanización Palo Campano -ubicada detrás del Liceo de Alajuelita- y las comunidades de San Josecito, Tejarcillos y San Felipe cuentan con el Parque de Desarrollo Humano. Por otra parte, se comprueba que el Parque de Desarrollo Humano se abastece de tres servicios de agua potable, específicamente NIS 5510719, 5543158 y 5549350, todos están ubicados en la vía pública y se facturan a nombre del MINISTERIO DE CULTURA Y JUVENTUD. Aunado a ello, se corrobora que la denuncia planteada por el recurrente el 04 de marzo de 2024, para la reparación de fuga de agua en el Parque de Desarrollo Humano y habilitación de bebederos públicos fue remitida a la cuenta de correo electrónico [email protected] asignada a la Presidencia Ejecutiva del ICAA; sin embargo, no corresponde a un medio oficial para recibir denuncias de los ciudadanos. Asimismo, se verifica que el ICCA recibió la denuncia presentada por el accionante, asignándosele el oficio 05032024 “Solicitud de reparación de fuga Nuevo Parque de Desarrollo Humano y habilitación de bebederos públicos” la cual fue trasladada al día siguiente para atención y resolución de la Gerencia General y Subgerencia Gestión de Sistemas GAM. Asimismo, fue notificado al propio denunciante en fecha 07 de marzo de 2024. Además, desde los días 06 y 07 de marzo de 2024, el ICAA mantuvo comunicación vía correo electrónico con el personal de la Municipalidad de Alajuelita debido a la denuncia de fuga planteada por el recurrente, de lo cual también se informó a la propia Junta Directiva Palo Campano. Además, mediante el informe “RESPUESTA OFICIO 05032024” de fecha 12 de marzo de 2024, se constata que el ICAA procedió a ejecutar la inspección de campo que permitió verificar la existencia de la fuga a lo interno del Parque de Desarrollo Humano ubicado en San Josecito de Alajuelita y en su efecto, la responsabilidad del administrador del parque para proceder con la reparación de la misma, lo cual fue comunicado a la Junta Directiva Palo Campano, recomendándose la interposición de la respectiva denuncia del caso ante el MINISTERIO DE CULTURA Y JUVENTUD -como abonado- para que se tomen las acciones necesarias, pues el agua derramada a causa de la fuga se está viendo reflejada en la facturación del servicio brindado.

Por otra parte, se constata que el 04 de marzo de 2024, el accionante envió su denuncia al correo [email protected] –asignado a la vice alcaldesa de la Municipalidad de Alajuelita-; sin embargo, no está previsto como mecanismo oficial para la recepción de gestiones de los usuarios. Para esos efectos se tienen las siguientes direcciones electrónicas: [email protected], [email protected] y [email protected]. Ahora bien, en el informe MA-AM-GAMB-017-2024 de fecha 20 de marzo de 2024, emitido por la encargada de Gestión Ambiental, Licda. Johanna Ávila Vargas se indicó lo siguiente: “... día 19 de octubre del 2023, se realizó una gira al Parque para el Desarrollo Humano de Alajuelita (PDHA) con la presencia de Patricia Sandoval, Keyli Mena, Ronald Sánchez, Teresita Zúñiga y Modesto Alpízar, alcalde, donde se encontraron basureros de reciclaje ubicados en la zona de parqueo, así como los ranchos ,lamentablemente vandalizados; razón por la cual , Gestión Ambiental, reparó de forma inmediata los cuatro ranchos del PDHA, dando reforzamiento a las bases con cemento, para evitar que los ranchos se cayeran y ocasionaran algún accidente, de igual forma, se realizó la limpieza y recolección de la basura fuera de los basureros y en toda la zona del parque, además, se dispuso, que tres veces por semana ingresen dos colaboradores al inmueble recolectando toda la basura y posteriormente se retira del parque ...”. Además, mediante el informe MA-AM-PO-0030-2024 de fecha 20 de marzo de 2024, la encargada de Parques y Ornato, Arquitecta Keyli Mena Alfaro señaló siguiente: “... que en el último trimestre del 2023, con exactitud en el mes de octubre Parques y Ornatos asume la responsabilidad del mantenimiento del PDHA, por lo que resta del año y con acuerdos pactados de que existiría vigilancia en el sector, debido a varias denuncias de hurto y robos en el sector. El mantenimiento se le ha dado a 8 hectáreas de espacio construido y utilizado por los residentes de las comunidades ...”. A su vez, a través del informe MA-AM-PM-066-2024 de fecha 21 de marzo de 2024, rendido por Johan Abarca Abarca, encargado de la Policía Municipal, se aseveró lo siguiente: “... se denota la actuación del cuerpo policial, quienes tienen incluido este parque dentro de sus labores operativas diarias, dentro del cantón se realizan recorridos preventivos y rutas establecidas, en estas, se visitan diversos puntos de interés del cantón, por su posible incidencia delictiva, cada punto se visita en la mañana, tarde y noche, generalmente en horarios entre las 9:00 y las 21:00 horas, según las jornadas laborales de este departamento; uno de estos puntos es el Parque de Desarrollo Humano, por lo cual diariamente el parque cuenta con presencia policial mínimo 3 veces ...”.

IV.- Es importante acotar en primer lugar, que no se logra acreditar que la gestión cuya falta de atención se acusa en el caso bajo estudio, haya sido planteada ante el ICCA y la Municipalidad de Alajuelita por medio de los canales oficiales establecidos para recibir comunicaciones. Por ende, la Sala no acredita la lesión a los derechos fundamentales de la parte tutelada en los términos en los que fue formulado el recurso, toda vez que en el sub iudice no consta que las autoridades accionadas hayan recibido en un medio oficial para plantear gestiones el correo electrónico de fecha 04 de marzo de 2024.

En segundo lugar, tal y como se constata del acervo probatorio, ambas instituciones atendieron las denuncias respectivas. En el caso del ICAA es claro en señalar en su informe, que al indicar que el Parque de Desarrollo Humano se abastece de tres servicios de agua potable -NIS 5510719, 5543158 y 5549350-todos ubicados en la vía pública y se facturan a nombre del MINISTERIO DE CULTURA Y JUVENTUD, es esta cartera ministerial la encargada -por así establecerlo la normativa vigente- la que debe solucionar el problema de la fuga de agua.

En mérito de lo expuesto, se evidencia que no ha existido un desacato por parte del ICAA, ni del gobierno local recurrido a algún precepto constitucional, siendo que la gestión presentada por la Junta Directiva Palo Campano con respecto a la fuga de agua en el Parque de Desarrollo Humano y las acciones vandálicas cometidas contra el referido parque fueron atendidas por ambas instituciones, todo lo cual le fue comunicado debidamente al propio denunciante.

V.- CONCLUSIÓN. En consecuencia, al no tenerse por demostrado ningún acto arbitrario en las condiciones que acusa el recurrente, lo que procede es declarar sin lugar el recurso en todos sus extremos, como en efecto se dispone.

VI.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:
