Document Review Decision No. 2024008751 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on cinco de abril de dos mil veinticuatro.
Amparo proceeding (recurso de amparo) filed by [Nombre01 001], identity card [Valor CED01], against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, the MINISTERIO DE SALUD, and the MUNICIPALIDAD DE MORAVIA.
BACKGROUND:
From the foregoing, it is clear that both the company and the AyA Project Implementation Unit have taken all necessary actions to mitigate the impacts that a project of such magnitude may cause. It is emphasized once again that the project has assigned personnel to the project’s social and environmental management, in order to monitor and verify impact mitigation, and these personnel are present every day at the various locations where the work is being performed. These institutional personnel are duly trained and have implemented procedures to assist users almost immediately, coordinating with the company so that any required work may be carried out. Lastly, given the lack of rainfall in the area, as part of the Institution’s commitment, bioremediation (Biorremediación) work has continued in the area, as has the weekly flushing of the stream with clean pressurized water from water tanks and tanker trucks.
These types of mitigation measures have again been scheduled for the week of 19 al 23 de febrero, and their continuation will be considered if necessary. (emphasis not in the original) SECOND: Regarding the allegation that “the work performed is causing a problem due to contamination of said stream, affecting my health and my right, as well as that of my family and my neighbors, to a healthy and ecologically balanced environment, because of foul odors that have continuously affected the residents’ quality of life and that emanate from said stream.” Rejected. Based on report PRE-PAPS-2024-00437: “…Contrary to the appellant’s assertion, the work performed by AyA consists of replacing the sanitary sewer pipeline (tubería sanitaria) to improve the sanitation system in the area. Its purpose is to restore sanitation conditions in quebrada Chiquita, protect the surrounding surface water and groundwater and riparian areas, and simultaneously contribute to the gradual improvement of the flow reaching Planta de Tratamiento Aguas Residuales Los Tajos, specifically by eliminating the discharges or raw wastewater sources that already existed at the site.
However, as already explained under FACT ONE, in order to replace the sanitary sewer pipeline, it was necessary to make a controlled, localized discharge (descarga controlada, puntual) into quebrada Chiquita for a specified period. The Ministerio de Salud was informed of this by a memorandum sent on 21 de diciembre del 2023 (Evidence 7), which described and justified the work. Based on the Declaration of National Advisability and Public Interest for the studies and works of the Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José to be undertaken by the Instituto Costarricense de Acueductos y Alcantarillados, pursuant to Decreto Nº 36529-MINAET, and the Gradual Implementation Decree, which declares the design, financing, construction, operation, and maintenance of the works required for the collection, treatment, and final disposal of ordinary wastewater generated in urban centers to be matters of public interest and social necessity, pursuant to Decreto Nº 32133-S, the controlled, localized discharge into quebrada Chiquita was carried out for a specified period, beginning on 21 de diciembre del 2023 and lasting for up to three months.
By 29 de enero del 2024, controlled wastewater discharges into the stream had ceased, because the collector pipeline (tubería del colector) had been successfully replaced. From the foregoing, it is clear that both the company and the AyA Project Implementation Unit have taken all necessary actions to mitigate the impacts that a project of such magnitude may cause; contrary to the appellant’s assertion, the work is intended to improve the wastewater-contamination conditions at the site…” THIRD: Regarding the allegation that: “Despite requests by several residents that the respondent authorities address this problem, wastewater continues to be discharged into that stream as of today, contaminating the environment and causing an intolerable situation because of the foul odors and other dangers created by polluting the stream to such an extent, when it was clean only a few months ago.” Rejected.
Based on report PRE-PAPS-2024-00437: “The amparo proceeding (recurso de amparo) was filed on 29 de enero del 2024; by that date, controlled wastewater discharges into the stream had ceased, because the collector pipeline had been successfully replaced. The residents of the area were informed of the foregoing by memorandum dated 29 de enero del 2024 (Evidence 9). Furthermore, contrary to the appellant’s assertion, the work performed by AyA consists of replacing the sanitary sewer pipeline to improve the sanitation system in the area. Its purpose is to restore sanitation conditions in quebrada Chiquita, protect the surrounding surface water and groundwater and riparian areas, and simultaneously contribute to the gradual improvement of the flow reaching Planta de Tratamiento Aguas Residuales Los Tajos, specifically by eliminating the discharges or raw wastewater sources that already existed at the site.” FOURTH: Regarding the allegation that: “This stream is contaminated with high levels of sewage, which has caused a serious public-health problem for residents of the area …” Rejected.
Based on report PRE-PAPS-2024-00437, as explained in the responses to Facts One and Two: The purpose of the work being performed is to improve the sanitation system in the area, thereby restoring sanitation conditions in quebrada Chiquita; protecting the surrounding surface water and groundwater and riparian areas; restoring and protecting the area’s fauna and flora; and specifically eliminating the discharges or raw wastewater sources that already existed at the site. To the extent necessarily dictated by engineering and construction constraints, this replacement work must be carried out through a controlled, localized discharge into quebrada Chiquita for a specified period. This work was and continues to be coordinated with the Ministerio de Salud, as explained under Fact One of this response and established by the Evidence attached to report PRE-PAPS-2024-00437. The work also has a legal basis in the Declaration of National Advisability and Public Interest for the studies and works of the Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José to be undertaken by the Instituto Costarricense de Acueductos y Alcantarillados, pursuant to Decreto Nº 36529- MINAET, and in the Gradual Implementation Decree, which declares the design, financing, construction, operation, and maintenance of the works required for the collection, treatment, and final disposal of ordinary wastewater generated in urban centers to be matters of public interest and social necessity, pursuant to Decreto Nº 32133-S.
That decree authorizes the controlled, localized discharge into quebrada Chiquita for a specified period, beginning on 21 de diciembre del 2023 and lasting for up to three months. “…By 29 de enero del 2024, controlled wastewater discharges into the stream had ceased, because the collector pipeline had been successfully replaced. From the foregoing, it is clear that both the company and the AyA Project Implementation Unit have taken all necessary actions to mitigate the impacts that a project of such magnitude may cause; contrary to the appellant’s assertion, the work is intended to improve the wastewater-contamination conditions at the site…” (Report PRE-PAPS-2024- 00437) FIFTH: Regarding the allegation that: “The problems reported to the Municipalidad de Moravia since 11 de enero de 2024 include serious problems at Dirección10 involving foul odors and sewerage problems. For several weeks, following the work performed by Acueductos y Alcantarillados near Parque Los Robles and Colegios Norte in Moravia, the sewage odor has continuously intensified 24 hours a day, and is even more noticeable during the night and early morning...” Rejected for the same reasons already explained under Facts Four, Two, and One.
This work is necessary for the replacement, collection, and treatment of wastewater; it is legally authorized and coordinated with the Ministerio de Salud. By 29 de enero del 2024, controlled wastewater discharges into the stream had ceased, because the collector pipeline had been successfully replaced.
SIXTH: Regarding the allegation that: “Today it was confirmed that, contrary to what the authorities verbally promised during neighborhood meetings, wastewater continues to be discharged into Quebrada Bonita, and the problem continues with no solution in sight. We have a video showing this situation.” Rejected based on Report PRE-PAPS-2024-00437: “…At none of the meetings held with residents of the area did AyA make any promise to stop discharging wastewater into quebrada Chiquita because, as stated under FACT ONE, the discharge was necessary in order to replace the sanitary sewer pipeline. AyA did undertake to perform actions to mitigate the impacts that a project of such magnitude may cause, all of which were detailed to the residents in a memorandum dated 29 de enero del 2024 (Evidence 9). It is important to note that by that date, controlled wastewater discharges into the stream had ceased, because the collector pipeline had been successfully replaced…” SEVENTH: Lastly, regarding the allegation that: “The Ministerio de Salud has failed to address this regrettable situation, which violates my right to health and that of my family and my community.” No ruling is made because this is not a fact of which AyA can have direct knowledge, nor does it concern actions by AyA. It need only be emphasized that all work performed was coordinated with the Ministerio de Salud, as established in the Report.
EIGHTH: Based on report DRyT-OMSR-2024- 00085, it should be stated that AyA conducted a series of inspections on 17 y 18 de Febrero 2024. These inspections were intended to assess the condition of the sanitary sewer network (red de alcantarillado sanitario) administered by AyA and to identify corrections to be made by the Local Government, actions to be taken by the Ministerio de Salud (conducting investigations in order to issue health orders (órdenes sanitarias) to certain residents), and corrections to be implemented by Unidad Ejecutora PAPS, as follows: “(…) I. Between Dirección11 and Dirección12, near Dirección06. An inspection was conducted at the site, where the sanitary sewer network was found to be functioning normally. No obstructions or operating abnormalities were observed, nor was there any evidence demonstrating that the network had discharged into quebrada Rivera. It should be noted that, at this location, the stream was observed to have a constriction that may prevent the pipeline from having sufficient capacity to convey stormwater during the rainy season.
In view of the foregoing, the Municipio de Moravia will be informed of this condition by means of official letter DRyT-OMSR-2024-00088. II. Within Parque Los Robles. AyA personnel assessed the operation of the sanitary sewer network within Parque Los Robles, and no evidence was observed demonstrating that the sewerage network had recently experienced any operating problem.
At this point, Quebrada Rivera is located a considerable distance away and is also piped, so it is considered that no condition has arisen at this location that would cause wastewater (aguas residuales) to be discharged into the creek. III. Los Colegios Norte, in the vicinity of the park located between Dirección09 and Dirección13. At this point, it was determined that an AyA main pipeline was diverted (Colector Rivera), apparently as part of the work on the Proyecto de Mejoramiento Ambiental, through the Unidad Ejecutora Programa de Agua Potable y Saneamiento (PAPS). When this diversion was carried out, a tertiary sanitary network was left connected to the original Colector Rivera pipeline when it should have been connected to the New Pipeline (Diversion). This condition causes wastewater to stagnate and generate foul odors. Based on field observations at point A (see image), the water collects in a manhole (pozo de registro), which fills until it reaches a point at which it discharges into the new pipeline; during this process, the water becomes septic and generates foul odors.
It should be noted that, at the time of the visit, the wastewater was not observed discharging into Quebrada Rivera. However, a significant change in the color of the water was observed, from the natural transparency of river water to the black color characteristic of septic water. In view of the foregoing, by memorandum DRyT-OMSR-2024-00087, the Unidad Ejecutora PAPS was informed so that it could immediately correct this condition. IV. The Los Colegios Norte Park. At this site, the sanitary sewer network (red de alcantarillado sanitario) was observed to be functioning normally, and no anomalies were identified in its operation. However, given the condition described in point III, the creek exhibited a flow of sewage (aguas negras). In addition, several properties adjoining the park were observed to be apparently discharging their wastewater into the creek. Accordingly, by official letter DRyT-OMSR-2024-00089, the Ministerio de Salud was informed of this condition so that it could conduct the corresponding investigations.
Lastly, it should be noted that no debris was observed in the creek at this site. V. Dirección10, located in Dirección14, behind AutoPits. At this site, the sanitary sewer network was functioning normally, and no anomalies were detected in its operation. With respect to the creek, no discharges originating from the sanitary network administered by AyA were observed; however, the flow conditions remained as observed at Point III. No flow conditions that could affect the properties were observed, although this is a condition characteristic of the dry season. 4. Work performed by the Dirección de Recolección y Tratamiento GSGAM. It is important to note that the Dirección de Recolección y Tratamiento GSGAM has not carried out, planned, or coordinated the development of capital works in this sector of Moravia that would generate foul-odor problems or cause pollution of Quebrada Rivera. As part of the investigative work undertaken to prepare this report, a location was identified where the operation of the sanitary sewer network had been modified.
The Unidad Ejecutora del Proyecto PAPS was asked to correct the condition found at Point III, the Municipalidad was asked to assess the condition of the creek at Point I, and the Ministerio de Salud was informed of the discharges found at Point IV. 5. Conclusions 1. Based on the information provided by the petitioner (recurrente), five locations were identified at which problems involving wastewater operation were reported. 2. Visits were conducted at the identified sites, and at none of them was wastewater found to be discharging into Quebrada Rivera. It should be noted that this condition may have occurred in the past, but it was not observed at the time of the visit. 3. At one of these locations, a defect in the operation of the sanitary sewer network was identified, and the Unidad Ejecutora PAPS was therefore asked to intervene immediately. 4. No debris or dangerous flow rates that could affect the properties were identified in the creek.
On the contrary, the low flow level of the creek causes septic water to stagnate beginning at Point III. It should be noted that this flow condition is characteristic of the dry season…” (emphasis not in the original) CONSIDERATION ON THE MERITS (CONSIDERACION DE FONDO) Regarding the potential impairment of citizens’ rights due to the scale of the work being carried out by AyA for the Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José at issue here, the Sala Constitucional, in decision 2017-001603 of nine twenty-five in the morning on the third of February, two thousand seventeen, previously held as follows: “Certainly, works of such magnitude as those examined in this case cause inconvenience to the free flow of traffic, since they entail work on and the closure of numerous streets for the installation of the infrastructure necessary for the sanitary sewer system. However, in the case at bar, it is apparent that AyA has taken appropriate measures to mitigate the impact.” The foregoing leads to the conclusion that any resulting inconvenience is temporary rather than permanent and is necessary for the work on and installation of infrastructure required, in accordance with the principles of science, technology, and engineering, for the proper replacement or installation of new pipelines, which will ultimately produce favorable conditions not only for the community but also for the environment. It has been demonstrated that, to the extent possible, the necessary measures have been taken to mitigate the impacts of a project of this magnitude. (…)
For the reasons stated above, and based on the principles of reasonableness and proportionality and the unequivocal rules of science and the technology of sanitary and environmental engineering, I request that the Honorable Justices DISMISS THIS AMPARO PROCEEDING IN ITS ENTIRETY, insofar as it concerns the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, because it has been demonstrated that, in order to replace these sanitary pipelines, it was necessary to conduct a controlled, localized discharge into Quebrada Chiquita for a specified period of time. The Ministerio de Salud was informed of this by a notice sent on 21 de diciembre del 2023 (Evidence 7 of Report PRE-PAPS-2024-00437), which described and justified the work, based on the Declaración de Conveniencia Nacional e Interés Público para los estudios y las obras del Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José a desarrollar por el Instituto Costarricense de Acueductos y Alcantarillados, under Decreto N.º 36529-MINAET, and the Decreto de Gradualidad, which declares the design, financing, execution, operation, and maintenance of the works required for the collection, treatment, and final disposal of ordinary wastewater generated in urban centers to be matters of public interest and social necessity, under Decreto N.º 32133-S, indicating that the work would begin on 21 de diciembre del 2023 and continue for up to three months.
By 29 de enero del 2024, controlled wastewater discharges into the creek had ceased because the collector pipeline (tubería del colector) had been successfully replaced. Furthermore, to mitigate the impacts resulting from the lack of rain in the sector, and as part of the Institution’s commitment, bioremediation work (labores de Biorremediación) has been carried out in the sector since enero del 2024, as has flushing the creek with clean pressurized water from tank trucks and tanker trucks. These mitigation measures (acciones de mitigación) are scheduled to be conducted again during the week of 19 al 23 de febrero, and their continuation will be considered if necessary. Based on the foregoing, it is clear that both the company and the Unidad Ejecutora del AyA have taken all measures necessary to mitigate the impacts that a project of such magnitude may cause. Following the inspection conducted by the Dirección de Recolección y Tratamiento DRyT-OMSR-2024-00085, recommendations falling within the authority of the Gobierno Local, the Ministerio de Salud, and the Unidad Ejecutora were issued so that the corresponding improvements could be implemented as a preventive measure.
Likewise, in light of the actions taken by the Instituto Costarricense de Acueductos y Alcantarillados in fulfillment of its purposes, it plainly has not disobeyed or violated any constitutional or environmental rules, guarantees, or principles; rather, it has acted responsibly to safeguard and protect the rights to the environment, health, and life, in accordance with the principle of legality (principio de legalidad) and the possibilities afforded by science, technology, and engineering in the pipeline-replacement work (…)”.

The following facts relevant to deciding this amparo proceeding are deemed established:
A. FACTS RELATED TO SEWAGE CONTAMINATION AND OTHER MATTERS:
“(…) Subject: Notice of wastewater discharge for the rehabilitation of the Rivera 2 Collector, between manholes 02-30A and 02-50A, Alcantarillado Sanitario Metropolitano Project/COMECO works package Dear Doctor, Within the context of International Tender N°2019LI-000011-PRI for the construction of the works package called ‘Construction and improvements of collectors and subcollectors in the Rivera, Torres, María Aguilar and Tiribi basins,’ known as COMECO, under the Alcantarillado Sanitario Metropolitano Project of the Instituto Costarricense de Acueductos y Alcantarillados (AyA), executed by SADE, the project provides for rehabilitation, by internally lining the pipe with a fiberglass sleeve using the CIPP (Cured In Place Pipe) method, of certain sections of the sanitary sewer system of the Rivera 2 Collector, located on the right and left banks of Quebrada Rivera in the Cantón Moravia.
The activities to be carried out specifically on Rivera 2 are located along the section between manholes 02-30A and 02-50A in the Los Colegios Norte sector (See Figure 1); manhole 02-30A is located inside Liceo Emma Gamboa, entering through Dirección09, and manhole 02-50ª is located 200m west of Supermercado Mayca in Llorente de Tibás, within the property on the right bank of Quebrada Rivera. Because of the high flow carried by this Rivera 2 collector, diameter Ø750mm and diameter Ø900mm, it is necessary to temporarily construct an overflow with a pipe of equal or greater size discharging into Quebrada Rivera at manholes 02 28 and 02 35, thereby reducing the flow so that it can be controlled at the manholes where work will be performed. The reference location of the works to be carried out and photographs of the system are shown in the images below (…)
It is therefore clear that the rehabilitation of the sanitary sewer pipe is intended to improve sanitation conditions, improve the integrity and service life of the pipe, eliminate existing discharges into the body of water, protect nearby surface water and groundwater and riparian areas, while also contributing to the gradual improvement of the flow reaching Planta de Tratamiento Aguas Residuales Los Tajos. These activities are scheduled to begin on 21 de Diciembre 2023 and are expected to last three months, with temporary, localized, and intermittent discharges as a safety measure enabling work under dry conditions, based on the technical premise that it is impossible to divert the wastewater to downstream manholes. If this period is extended, timely notice will be provided. It should be noted that the Proyecto de Alcantarillado Sanitario Metropolitano has a Declaration of National Benefit and Public Interest for the studies and works of the Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José to be undertaken by the Instituto Costarricense de Acueductos y Alcantarillados, under Decreto Nº 36529- MINAET, as well as a Gradual Implementation Decree (Decreto de Gradualidad) declaring the design, financing, execution, operation, and maintenance of the works required for the collection, treatment, and final disposal of ordinary wastewater generated in urban centers to be matters of public interest and social necessity, under Decreto Nº 32133-S.
We remain available should any additional information on this matter or a joint site visit to inspect the work in progress be required. Specifically, as a result of those actions, the following was determined:
(…) I. Between Dirección11 and Dirección12, near Dirección06. An inspection of the site was conducted, and the sanitary sewer network was found to be functioning normally. No obstructions or operating anomalies were observed, nor was there any evidence showing that the network had discharged into Quebrada Rivera. It should be noted that, at this location, the stream was observed to have a constriction that could cause the pipe to lack sufficient capacity to convey stormwater during the rainy season. In view of the foregoing, this condition will be reported to the Municipalidad de Moravia through official letter (oficio) DRyT-OMSR-2024-00088.
II.Within Parque Los Robles. AyA personnel assessed the operation of the sanitary sewer system (red de alcantarillado sanitario) within Parque Los Robles, and no indication was observed that the sewer system had recently experienced any operational problem. At this location, Quebrada Rivera is a considerable distance away and is also piped, so it is considered that no condition has occurred here that would cause wastewater (aguas residuales) to discharge into the stream.
III.Los Colegios Norte, in the vicinity of the park located between Dirección09 and Dirección13. At this location, it was identified that a main AyA pipeline was diverted (Colector Rivera), apparently as part of the work under the Proyecto de Mejoramiento Ambiental, through the Unidad Ejecutora Programa de Agua Potable y Saneamiento (PAPS). When this diversion was carried out, a tertiary sanitary sewer line was left connected to the original Colector Rivera pipeline when it should have been connected to the Nueva Tubería (Desvío). This condition causes wastewater to stagnate and generate foul odors. Based on what was observed in the field at point A (see image), the water collects in a manhole (pozo de registro), which fills until it reaches a point where it spills into the new pipeline; during this process, the water becomes septic and generates foul odors. It should be noted that, at the time of the visit, no wastewater was observed discharging into Quebrada Rivera. However, a significant change in the color of the water was observed, from the natural transparent color of river water to the black color characteristic of septic water. In view of the foregoing, through memorandum DRyT-OMSR-2024-00087, the PAPS Unidad Ejecutora was informed so that it could immediately correct this condition.
IV.Parque de Los Colegios Norte. At this site, the sanitary sewer system was observed to be operating normally, and no operational anomalies were identified. Nevertheless, because of the condition described in point III, the stream exhibited a flow of sewage (aguas negras). In addition, it was observed that several properties adjoining the park apparently discharge their wastewater into the stream. Accordingly, through official letter DRyT-OMSR-2024-00089, the Ministerio de Salud was informed of this condition so that it could conduct the corresponding investigations. Lastly, it should be noted that no debris was observed in the stream at this site.
V.Dirección10, located at Dirección14, behind AutoPits. At this site, the sanitary sewer system is operating normally, and no operational anomalies were detected. As regards the stream, no discharges originating from the sanitary sewer system managed by AyA were observed; however, the flow conditions remain as observed at point III. No flow conditions that could affect the properties were observed, although this is a condition characteristic of the dry season.
4. Work performed by the Dirección de Recolección y Tratamiento GSGAM. It is important to note that the Dirección de Recolección y Tratamiento GSGAM has not carried out, planned, or coordinated the development of capital works in this sector of Moravia that might cause foul-odor problems or pollution of Quebrada Rivera. As part of the investigative work undertaken to prepare this report, a location was identified where the operation of the sanitary sewer system had been modified. The PAPS Unidad Ejecutora was asked to correct the condition found at point III, the Municipalidad was asked to assess the condition of the stream at point I, and the Ministerio de Salud was informed of the discharges found at point IV.
5. Conclusions 1. Based on the information provided by the petitioner, 5 locations were identified where problems involving the handling of wastewater were alleged. 2. Visits were made to the identified sites, and at none of them was wastewater found to be discharging into Quebrada Rivera. It should be noted that this condition may have occurred in the past, but it was not observed at the time of the visit. 3. At one of these locations, a defect in the operation of the sanitary sewer system was identified, and the PAPS Unidad Ejecutora was therefore asked to intervene immediately. 4. No debris or dangerous flows capable of affecting the properties were identified in the stream. On the contrary, the stream’s low flow level causes septic water to stagnate downstream from point III. It should be noted that this flow condition is characteristic of the dry season (…)” (see report and evidence).
B. FACTS RELATED TO THE RETAINING WALL (MURO DE CONTENCIÓN) (BARRIO EL CARMEN SECTOR).
“(…) 4.8 Evaluation of Results and Conclusions • The required protective works are located in Barrio El Carmen, District 01 San Vicente, Canton 14 Moravia, Province 01 San José, at the Dirección17 coordinates—CRTM 05 projection, on Quebrada Chiquita. • Quebrada Chiquita is a tributary of Quebrada Rivera (the major Río Virilla watershed). This watercourse exhibits the characteristics of a drainage ditch that collects stormwater discharges from the surrounding communities. Its protected area (área de protección), corresponding to the 10-meter strip measured from the bank of the watercourse, as stipulated in Ley Forestal Nº7575, Article 33, is heavily encroached upon. The protected area is obstructed by the construction of fences and retaining walls (muros de retención). • There is currently a bridge at the site, consisting of a concrete slab with a depth of approximately 40 cm and concrete abutments.
The bridge has a span of 3 meters and a vertical clearance of 5 meters. Immediately downstream from the bridge, there is a step or drop approximately 1.8 meters high. The bed consists of highly compacted and consolidated soil. • The high velocity of the water flow, combined with the drop in the bed, has caused accelerated scouring (socavación) of the watercourse, endangering the bridge structure and the banks of the Quebrada. • The watershed (cuenca hidrográfica) of Quebrada Chiquita (a tributary of Quebrada Rivera) has an area of 0.93 km2 and a channel length of 2.4 km. The maximum elevation of the watershed evaluated is 1 245 masl, and the minimum elevation is 1189 masl, at the vehicle crossing over Quebrada Chiquita. • Most of the watershed’s surface consists of urban/commercial development. (…) To comply with the foregoing, a bridge is proposed with a span of 4.9 meters, an average vertical clearance of 3.6 meters above the base elevation of 1199 masl, and a depth of 0.50 m. This provides 1.0 m of freeboard (borde libre).
(…) Given that the Quebrada already exhibits highly aggressive scouring in the study area, it is assumed that general scouring and scouring at the piers of the abutments may affect the existing works. In view of the foregoing, it will be necessary to implement scour-protection works at the abutments of the new bridge, as well as on the bed and both banks.
To accomplish this, the proposal includes the following measures: • Demolition of the existing bridge and construction of a new bridge with the dimensions indicated in the preceding paragraph. • Excavation and shaping of the watercourse’s cross-section beginning at Dirección18, where the bed elevation will be 1 199 masl, and continuing to the bridge section.
• Cyclopean concrete slab or shotcrete on the bed of the watercourse from Dirección19 to Dirección20. Reinforced concrete is not required because, under the new watercourse conditions, the water velocity ranges from 4 to 6 m/s. Reinforced concrete is recommended for velocities greater than 10 m/s. • Sidewall on both banks from Dirección19 to Dirección20. The use of shotcrete with anchor bolts is recommended because of the difficulty of implementing another construction method at the site. (…) • The outlet apron (delantal) will be 7.5 meters long, with steps or drops every 2.5 meters and a height of 0.5 m. Cyclopean concrete is recommended for the apron (…)
8. DETAILED COST OF THE PROPOSED SOLUTION (…) ₡ 151 087 397,85 (…)” (see report and evidence).
C. FACTS RELATED TO THE COMPLAINT FILED BY THE AFFECTED RESIDENTS.
“(…) Since the alleged recent works carried out by Acueductos y Alcantarillados on the sewerage network in Moravia, including work performed near the spring (naciente) of the Quebrada known as Chiquita or Rivera, located across from Parque Los Robles, as well as the works carried out by the Municipalidad de Moravia in the Los Colegios Norte park, an ongoing and significant problem has arisen in connection with the sewerage system, causing persistent sewage odors emanating from that Quebrada that have affected the residents’ quality of life (…) This problem has become increasingly serious, causing distress throughout the community and directly violating our fundamental right to enjoy a healthy and ecologically balanced environment (…) This complaint comprises three main issues.
First: Dirección10, foul odors and sewerage problems: For several weeks, following the works carried out by Acueductos y Alcantarillados near Parque Los Robles and Colegios Norte in Moravia, the sewage odor has continuously intensified 24 hours a day and is even more noticeable at night and in the early morning. These odors enter our homes, affecting the quality of sleep and health of all residents, including children, adults, and older persons, to the point that outbreaks of diarrhea have been reported in Barrio El Carmen, located at Dirección21, behind AutoPits. In addition, the low flow in the Quebrada has caused sewage to accumulate and stagnate, producing nauseating odors and attracting pests, thereby posing a risk to the community’s health. This problem had never previously occurred in this community. It is further reported that the retaining wall at this location collapsed two years ago, but there has been no intervention to rebuild it and reinstall the mesh barrier, creating an imminent danger of serious injury to residents.
If a person were to fall into the watercourse, not only could the height cause serious injuries, but falling into sewage-contaminated water would also pose a serious health risk from exposure. It should be noted that, in recent days, a resident’s dog fell into the watercourse; an older resident entered it to rescue the dog, placing his own safety at risk, and he also reports the condition of the Quebrada. (…)
Problems with the sewerage system: The alleged new connections made by Acueductos y Alcantarillados reportedly cause water to overflow from the sewer adjacent to Quebrada Chiquita/Rivera at Dirección14, Barrio El Carmen, whenever it rains. At this same location, it is important to note that residents have reported that, during the early morning and morning hours—and in this instance without any rainfall—what appears to be pressurized sewage is discharged and merges with the sewage carried by Quebrada Chiquita. In other words, this sewer collects not only stormwater but also sewage from another area. In addition, the pressurized overflow from the sewer strikes a resident’s wall and has already caused damage that may endanger his home because of the new sewer connections, as the sewer collapses when it rains. Although several residents have reported this situation, no government entity has taken any action to correct the problem since the Quebrada’s retaining wall collapsed, further aggravating the situation.
The only action taken by the municipality was to “clear” the debris and close the bridge, which residents had already reported years earlier, and repeatedly thereafter, as being unstable (…) We urgently and earnestly request your prompt intervention and attention to this problem, with a view to finding a comprehensive solution that safeguards our fundamental rights and promotes a healthy and safe environment for all community residents, as established by the Political Constitution in the articles previously cited. There is an imminent danger that someone will fall into the Quebrada because of the lack of a retaining wall and mesh barrier, compounded by the imminent and serious health hazard posed by the stagnant sewage with which it is filled. Images proving this are attached.
Second: Barrio Sagrado Corazón Complaint: Other residents have informed us of the following: 1. Regarding Quebrada Chiquita, near the bridge at Dirección03, located at Dirección13, between Dirección22, the water appears somewhat clean, but downstream from Condominios Topacio and the new Tramontal, upon crossing the bridge at Dirección23 (El Bajillo), located at Dirección09, between Dirección24, the water is already flowing completely contaminated with sewage because the sewage was diverted and discharged into Quebrada Chiquita. a. In addition, a couple of months ago, Acueductos y Alcantarillados carried out works near Parque Los Robles, where Quebrada Chiquita, also known as Rivera, originates. For reference, it originates between Dirección11 and Dirección12. 2. Acueductos y Alcantarillados performed work near Barrio Sagrado Corazón and allegedly needed to work with dry pipes, so it diverted certain wastewater (aguas servidas) into the Quebrada. See Annex lll. The danger to public health is a fundamental issue that requires attention because this water contains bacteria that may cause bacterial infections, viral infections, parasitic infections, etc. Residents report outbreaks of diarrhea, which very likely originate from this water.
Third: Colegios Norte Complaint: Watercourse containing sewage; unauthorized works in the watercourse that changed its direction and damaged residents’ walls. Residents of Los Colegios Norte report that, near the park located between Dirección09 and Dirección13, through which the Quebrada flows, sewage odors also persist 24 hours a day following the alleged work carried out by Acueductos y Alcantarillados. Residents report not only odors but also the presence of soapy water. At this location, residents report that municipal personnel, acting negligently and willfully during the performance of the works known as “Comprehensive Renovation and Beautification of the Urbanización Colegios Norte Park,” under contract OC 931925, dumped rubble and soil into the watercourse itself, consequently diverting it and also causing water to stagnate in certain areas, thereby retaining sewage there. This event is documented and supported by videos attached on the USB flash drives; the Fuerza Pública was even called that day, but the Municipalidad proceeded with its works.
This also caused direct harm to residents whose properties adjoin the watercourse, with the Quebrada thereby eroding the easement/setback areas (servidumbre/retiro) and endangering the walls and homes. It should be noted that this also occurred years ago at Dirección10 when the watercourse was placed in a pipe, thereby diverting it and causing the Quebrada itself to change course and damage and erode the easement/setback areas adjacent to residents’ walls (…)”. That submission listed the following email addresses as means for service of notices: ...03 and ...04 (see evidence).
“(…) In response to the note submitted on 11 de enero de 2024 by residents of Dirección25, Dirección06, and Dirección26 in San Vicente de Moravia, this document is issued for the purpose of specifically addressing the matters stated therein: The Instituto Costarricense de Acueductos y Alcantarillados (AyA) is constructing the sanitary sewer system (sistema de alcantarillado sanitario) through the Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José (AMSJ) in 11 cantons of the province. Its purpose is to improve the population’s environmental and public-health conditions by rehabilitating and expanding the coverage of the existing sanitary sewer system in the AMSJ and by operating the treatment plant for wastewater (aguas residuales) originating from this system. The Proyecto de Mejoramiento Ambiental was declared to be of National Convenience and Public Interest (Conveniencia Nacional e Interés Público) by Decreto 3652 in abril 2011.
Because the effects of pollution are concentrated in the lower portion of the Río Tárcoles watershed (cuenca), the Municipalidad de Puntarenas, the Defensoría de los Habitantes, and the Garabito Ecológico party filed an amparo petition (recurso de amparo) with the Sala Constitucional on 19 de agosto de 2004. It issued constitutional decision number 5894-07, which requires all public institutions, including the Instituto Costarricense de Acueductos y Alcantarillado (AyA), to take immediate action as necessary to eliminate the sources of pollution existing throughout the Río Grande de Tárcoles watershed and restore the environmental damage caused therein. The contract awarded under International Public Tender (Licitación Pública Internacional) 2019LI-000011-PRI, entitled “Construction and Improvements of Main and Branch Sewers in the Rivera, Torres, María Aguilar, and Tiribí Watersheds,” is currently being performed in the cantons of San José, Goicoechea, Montes de Oca, Vázquez de Coronado, Moravia, Desamparados, Alajuelita, and Tibás, Provincia San José.
Its contractual scope includes extending the sanitary sewer system in the northern sector of downtown San José. It is important to mention that, due to the impact of the works, the project undertakes a community-engagement process involving actions such as: • The Contractor has a community-engagement plan that is approved and supervised by the Inspection, Social and Communications Support and Coordination team of AyA’s Unidad Ejecutora. This plan establishes social measures to be carried out before, during, and upon completion of the interventions throughout the works in the areas concerned. • A survey of stakeholders is conducted, including companies, institutions, businesses, and any other stakeholders deemed relevant, to collect contact information and maintain ongoing communication regarding the various stages of the construction process. • AyA maintains a team of Social Outreach Officers to assist with coordination and situations arising in the areas affected by the works.
In addition to the foregoing, the following activities have been carried out: 1. Meetings with stakeholders such as development associations and institutions including Municipalidad de Moravia and Área Rectora de Salud. (…) 2. Communications have been conducted through leaflet distribution, dissemination of information by email, messaging groups (WhatsApp), and loudspeaker announcements to provide information about the works. (…) Background to the complaint filed by the residents: Previously, during the rainy season, there have been overflows from a sanitary sewer manhole (pozo sanitario) in Parque Municipal de Los Robles due to illegal connections carrying stormwater (aguas pluviales) from homes into the sanitary sewer system. It has been clarified that stormwater must flow through the roadside drains and into the river because, in principle, it is not contaminated water and must be kept separate from wastewater, which must flow through AyA’s sanitary sewer main (colector) and to Planta de Tratamiento Los Tajos for proper treatment.
Regarding instances of water overflowing from the sanitary sewer system, it should be noted that this situation occurs during heavy rainfall due to unlawful stormwater connections to the sanitary sewer system within that system’s area of influence, which has caused some manholes to overflow. Nevertheless, as part of the sanitary works currently under way in the sector, the Institution has made several significant improvements extending from the Luis Ángel “Pipilo” Umaña stadium area, through Parque Los Robles (Dirección27), to the intersection of Dirección13 and Dirección12 (manhole 2-23A). These improvements have enhanced local conditions and include: • Replacement of the existing pipeline, increasing its diameter from 450mm to 600mm, thereby providing greater hydraulic capacity. • In that same sector, the pipeline was found to have a severe obstruction caused by roots and debris, which reduced its capacity by approximately 90% and exacerbated the overflow problem; accordingly, the pipeline was cleaned using robotic equipment.
It should be noted that throughout this sector there were already discharges into quebrada Chiquita due to the age and deterioration of the old pipeline, and this AyA sanitary sewer project is specifically intended to eliminate those discharges into the body of water. Likewise, this pipeline is currently being replaced from Los Robles to Los Colegios Norte, which will greatly help eliminate these overflows. However, the definitive solution to the overflows is not within AyA’s sole control; it must be undertaken by several institutions and led by the Ministerio de Salud, because that institution has the authority to inspect homes and issue health orders (órdenes sanitarias) requiring correction of stormwater connections discharging into the sanitary sewer system, or vice versa. The same applies to one of the videos submitted with the complaint concerning El Carmen, specifically Dirección28, where joint inter-institutional action is required together with the works that remain to be performed in the sector.
The note submitted by the residents contains four requests; accordingly, the requests specifically pertaining to AyA’s Proyecto de Alcantarillado Sanitario are addressed below: • The residents’ request in the complaint that the watercourse (cauce) be inspected to halt the discharge of wastewater and that measures be taken to eliminate pollution in Quebrada Chiquita (requests 2 and 3). It must be clarified that, to carry out the sanitary sewer works extending from Los Robles toward Los Colegios Norte, it was necessary to establish a controlled, point-source discharge for a specified period, during which flow from the sanitary sewer network was temporarily diverted into quebrada Chiquita. The Ministerio de Salud was informed of the works through a note sent on 21 de diciembre del 2023, which described and justified the work: “Because of the high flow carried by this Rivera 2 main sewer, with a diameter of Ø750mm and a diameter of Ø900mm, it is necessary to temporarily construct an overflow using a pipeline of equal or greater size discharging into quebrada Rivera at manholes 02-28 and 02-35, thereby reducing the flow so that conditions can be controlled in the manholes where work will be performed.
The reference location of the works to be carried out and photographs of the system are shown in the images below.” (…) The note submitted to the Ministerio de Salud is attached as Anexo 1 (A1.) to this document. Additionally, meetings were held with stakeholders before the project works began at the site to provide information about the interventions: • Meeting at Municipalidad de Moravia with the Ministerio de Salud and the Asociación de Desarrollo Integral de Los Robles on 07 de julio del 2022. (…) • Meeting with Municipalidad de Moravia and the Área Rectora del Ministerio de Salud de Moravia to provide information about the work and construction to be carried out under this project (including the overflow mentioned above). This meeting was held on 25 de enero del 2023 at the offices of the Ministerio de Salud de Moravia. (…) There are currently no wastewater discharges into the stream; the main sewer pipeline was successfully replaced.
With regard to the discharge made in recent days, the mitigation measures (medidas de mitigación) that have been taken should be noted: 1. During the days when the overflow occurred, assistance was provided to residents and the stream was flushed with pressurized clean water from water trucks and tanker trucks. (…) 2. Continuous monitoring by the environmental managers of both the Contractor and AyA’s Environmental Inspection team to determine the best locations for applying clean water. 3. As a support and mitigation measure and to improve the stream’s condition, on Friday 26 de enero, bioremediation microorganisms were applied to reduce the organic load and foul odors present in various parts of the body of water (Anexo 7). (…) It should be emphasized that, during the inspections and visits conducted at quebrada Chiquita, wastewater discharges were observed from pipelines adjacent to residents’ homes, further polluting the surface water.
This is clearly unrelated to the project, but it imposes a significant pollutant load on the stream. (…) It is therefore clear that the replacement of the sanitary pipeline and the comprehensive improvement of the sanitary sewer system in the sector are intended to restore sanitation conditions in quebrada Chiquita; protect the surrounding surface water, groundwater, and riparian areas; and simultaneously contribute to the gradual improvement of the flow reaching Planta de Tratamiento Aguas Residuales Los Tajos by eliminating untreated wastewater discharges or sources. (…) We remain available should you consider any further clarification necessary, and we are at your disposal for any joint visit or meeting (…)” (see evidence).
The petitioner (recurrente) asserts that a complaint was filed with the respondent authorities (autoridades recurridas) on 11 de enero de 2024, referring to sewage pollution in certain sectors of Moravia and to the collapse of a retaining wall and bridge. However, the petitioner alleges that, as of the date this amparo proceeding was filed, that complaint had not been resolved.
To rule on the merits of this particular claim, it must first be clarified that, beginning with Judgment No. 2008-02545, issued at 8:55 on 22 de febrero de 2008, this Sala has referred to the contentious-administrative jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters involving disputes over whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, whether to conclude an administrative proceeding—initiated ex officio or at the request of a party—by means of a final administrative act (acto final), or to adjudicate the applicable administrative appeals (recursos administrativos). This case presents precisely such an exception—supported by a majority of this Tribunal Constitucional—because it concerns complaints regarding environmental pollution that allegedly were not resolved within a reasonable period.
Having clarified the point, this Court finds that this particular claim in the application for amparo (recurso de amparo) must be dismissed. This is because, as of the date this amparo proceeding was filed, namely, 29 de enero de 2024, an excessive and unreasonable period had not elapsed for addressing and resolving the complaint (denuncia), which had been filed only on 11 de enero del año en curso, that is, barely eighteen days earlier.
Thus, it is clear that, as of the date this proceeding was filed, the respondent parties still had time to issue a formal decision on the complaint under review. Accordingly, the Court finds that the amparo is premature with respect to this claim and, therefore, because no violation of any fundamental right has been established, it must be dismissed.
In any event, it must be noted that it has been established that, by means of a letter dated 29 de enero de 2024 (served on the interested parties on an unspecified date), the ICAA authorities ruled on that complaint and provided a response.
The petitioner alleges that, as part of works carried out in the Cantón de Moravia, the ICAA authorities diverted wastewater or sewage toward Quebrada Chiquita, thereby causing serious pollution and adversely affecting the health of the residents of Dirección10, Dirección06, and Los Colegios Norte. He further alleges that the new connections installed by the ICAA have also caused the sewer adjoining Quebrada Chiquita in Barrio El Carmen to overflow with sewage when it rains.
Upon review of the case record, it has been established that the ICAA authorities are responsible for the so-called Metropolitan Sanitary Sewerage Project (Proyecto de Alcantarillado Sanitario Metropolitano), whose objective is to “Improve the current conditions of the rivers and environment of the Área Metropolitana de San José caused by untreated wastewater discharges, through the rehabilitation and expansion of the sanitary sewerage system (sistema de alcantarillado sanitario) and the construction of a treatment plant.” According to the evidence, this objective is intended to be achieved through the rehabilitation and expansion of the existing sanitary sewerage coverage in the Área Metropolitana, as well as through the incorporation of a treatment plant for wastewater originating from this system, which was inaugurated in 2015.
The record shows that, to carry out this project, International Public Tender No. 2019LI was issued: “Construction and Improvement of Main and Secondary Sewer Collectors in the Rivera, Torres, María Aguilar, and Tiribí Watersheds.” It was also established that the works relating to this project are supported by the following decrees and decisions: - Decision No. 852-2001 SETENA of 13 de diciembre de 2001, through which the Secretaría Técnica Nacional Ambiental approved the environmental impact study (Estudio de Impacto Ambiental) for the “Metropolitan Sanitary Sewerage Project” and the project annex. - Decree No. 32133-S of 7 de diciembre de 2004, declaring the design, financing, execution, operation, and maintenance of works for the collection, treatment, and final disposal of wastewater generated in urban centers to be matters of public interest and social necessity. - Decision No. 460-2005-SETENA of 3 de marzo de 2005, approving amendments to the environmental impact study for the “Metropolitan Sanitary Sewerage Project.” - Executive Decree No. 36529-MINAET of 14 de abril de 2011, corresponding to the Declaration of National Benefit and Public Interest for the studies and works of the Environmental Improvement Project for the Área Metropolitana de San José to be undertaken by the Instituto Costarricense de Acueductos y Alcantarillados. - Decision 503-2016-SETENA of 15 de marzo de 2016, approving the updated Environmental Management Plan (Plan de Gestión Ambiental), Collectors component (northern and southern sectors), for the Metropolitan Sanitary Sewerage Project. - Environmental Management Plan for the construction and rehabilitation of main and secondary sewer collectors in the northern and southern sectors, Metropolitan Sanitary Sewerage Project.
In addition, it has been established that, as part of the aforementioned project, the ICAA has been carrying out sanitary sewerage improvement works from Los Robles to Los Colegios Norte (sectors belonging to the cantón de Moravia). To perform this work, the ICAA retained SADE Compagnie Générale De Travaux D’ Hydraulique (through the aforementioned international public tender 2019LI-000011-PRI); its work began in abril del 2021 and will conclude at the end of 2024.
The record also shows that, to carry out the aforementioned sanitary sewerage works—specifically, replacements of sanitary sewer pipes—the ICAA authorities originally arranged for a controlled, localized discharge of flow from the sanitary sewer network into Quebrada Chiquita over a three-month period beginning on 21 de diciembre de 2023.
As a result, it was established that prior community outreach was conducted through the following actions: 7 de julio de 2022 (meeting at the Municipalidad de Moravia with the Ministerio de Salud and the Asociación de Desarrollo Integral de Los Robles); 25 de enero de 2023 (meeting at the offices of the Ministerio de Salud de Moravia with the Municipalidad de Moravia to provide information about the work to be performed); 4 de septiembre de 2023 (meeting between ICAA officials and representatives of Liceo Laboratorio Emma Gamboa); communications were conducted through the distribution of flyers and information by email and messaging groups (WhatsApp), and public-address announcements were made to provide information about the works.
The record further shows that, in order to carry out the aforementioned discharges, the ICAA notified the Director del Área Rectora de Salud de Moravia by a letter sent on 21 de diciembre de 2023 (describing the work to be performed and the reasons for it). Among other matters, the letter stated that, to achieve the project’s objective, it was necessary to “(…) temporarily construct an overflow using a pipe of equal or larger size discharging into Quebrada Rivera at Dirección29, thereby reducing the flow in order to maintain control in the manholes to be worked on (…)”.
It was also established that, on the days when those discharges occurred, the ICAA implemented several mitigation measures (medidas de mitigación) to reduce the inconvenience that might be caused, namely: 1. On the days when the discharge occurred, residents were assisted and the scope of the work being performed was explained to them. 2. The creek was flushed with pressurized clean water from water tanks and tanker trucks. 3. Environmental managers from both the contractor and the ICAA Environmental Inspection unit conducted constant monitoring in order to determine the best locations for applying clean water. 4. On viernes 26 de enero de 2024, bioremediation microorganisms were applied in order to reduce the organic load and foul odors present in various parts of the body of water. It was further reported that, due to the lack of rainfall in the Moravia sector, these authorities continued carrying out bioremediation work and weekly flushing of the creek with pressurized clean water from water tanks and tanker trucks.
It was stated under oath that, as of 29 de enero de 2024 (the date this amparo was filed), “(…) there were no longer any controlled wastewater discharges into the creek, because the collector pipe had been successfully replaced (…)”.
In addition, it was determined that, on 17 y 18 de febrero de 2024, as a result of the filing of this amparo, the ICAA authorities conducted a series of inspections in the aforementioned areas of Moravia in order to “(…) assess the condition of the sanitary sewerage network administered by AyA, identifying corrective work to be performed by the Local Government, actions to be taken by the Ministerio de Salud (conducting investigations to issue health orders (órdenes sanitarias) to certain residents), and corrective work to be implemented by the Unidad Ejecutora PAPS (…)”.
Specifically, the following was determined as a result of those measures:
“(…) I. Between Dirección11 and Dirección12, near Dirección06. An inspection of the site was conducted, and the sanitary sewerage network was found to be operating normally. No obstructions or operational anomalies were observed, nor was there any evidence showing that the network had discharged into Quebrada Rivera. It should be noted that, at this location, the creek was observed to have a constriction that may cause the pipe to lack sufficient capacity to convey rainwater during the rainy season. In view of the foregoing, the Municipio de Moravia will be informed of this condition through official letter DRyT-OMSR-2024-00088.
II.Within Parque Los Robles. AyA personnel assessed the operation of the sanitary sewerage network within Parque Los Robles, and no indication was observed that the sewerage network had recently experienced any operational problem. At this location, Quebrada Rivera is a considerable distance away and is also piped underground; accordingly, it is considered that no condition has occurred at this site that would cause wastewater to discharge into the creek.
III.Los Colegios Norte, in the vicinity of the park located between Dirección09 and Dirección13. At this location, it was identified that an AyA main pipeline was diverted (Colector Rivera), apparently as part of the work under the Proyecto de Mejoramiento Ambiental, through the Unidad Ejecutora Programa de Agua Potable y Saneamiento (PAPS). When this diversion was carried out, a tertiary sanitary sewer line was left connected to the original Colector Rivera pipeline, when it should have been connected to the New Pipeline (Diversion). This condition causes wastewater to stagnate and generate foul odors. Based on the field observations at point A (see image), the water accumulates in a manhole, which fills until reaching a point at which it spills into the new pipeline; during this process, the water becomes septic and generates foul odors. It should be noted that, at the time of the visit, wastewater was not observed discharging into Quebrada Rivera. However, a significant change in the water’s color was observed, from the naturally clear color of river water to the black color characteristic of septic water. In view of the foregoing, through memorandum DRyT-OMSR-2024-00087, the Unidad Ejecutora PAPS is being informed so that it may immediately correct this condition.
IV.Parque de Los Colegios Norte. At this site, the sanitary sewerage network was observed to be operating normally, and no operational anomalies were identified. However, because of the condition described in point III, the creek exhibits a flow of sewage. In addition, several properties adjoining the park were observed to be apparently discharging their wastewater into the creek. In view of the foregoing, through official letter DRyT-OMSR-2024-00089, the Ministerio de Salud is being informed of this condition so that it may conduct the corresponding investigations. Finally, it should be noted that no debris was observed in the creek at this site.
V.Dirección10, located at Dirección14, behind AutoPits. At this site, the sanitary sewer network (red de alcantarillado sanitario) is operating normally, and no anomalies were detected in its operation. With respect to the stream (quebrada), no discharges from the sewer network administered by AyA were observed; however, the flow conditions remain as observed at Point III. No flow-rate conditions (condiciones en el caudal) that could affect the properties were observed, but this is a condition characteristic of the dry season.
4. Work performed by the Dirección de Recolección y Tratamiento GSGAM. It is considered important to mention that the Dirección de Recolección y Tratamiento GSGAM has not carried out, planned, or coordinated the development of capital works in this sector of Moravia that might generate foul-odor problems or cause pollution of the Quebrada Rivera. As part of the investigative work undertaken to prepare this report, a point was identified where the operation of the sanitary sewer network had been modified. The Unidad Ejecutora del Proyecto PAPS was asked to correct the condition found at Point III, the Municipalidad was asked to assess the condition of the stream at Point I, and the Ministerio de Salud was informed of the discharges found at Point IV.
5. Conclusions 1. Based on the information provided by the petitioner, five points were identified where a problem involving wastewater (aguas residuales) management was reported. 2. Visits were made to the identified sites, and at none of them was wastewater found to be discharging into the Quebrada Rivera. It should be noted that this condition may have occurred in the past, but it was not observed at the time of the visit. 3. At one of these points, a defect in the operation of the sanitary sewer network was identified, and the Unidad Ejecutora PAPS was therefore asked to intervene immediately. 4. No debris was identified in the stream, nor were any hazardous flow rates that could affect the properties observed. On the contrary, the stream’s low flow level causes septic wastewater (aguas sépticas) to stagnate beginning at Point III. It should be noted that this flow condition is characteristic of the dry season (…)”.
Additionally, it was determined that, as a result of the findings from those proceedings, on February 19, 2024, the ICAA authorities sent a series of official letters to other institutions in order to address the situation that had arisen. Thus, official letter No. DRyT-OMSR-2024-00087 of February 19, 2024, shows that the ICAA authorities communicated the following to that same institute’s Unidad Ejecutora Programa de Agua Potable y Saneamiento (PAPS):
“(…) As part of the inspections conducted to prepare the report requested by the Dirección Jurídica following the filing of the amparo proceeding (Recurso de Amparo) – Expediente 24-002429-0007-CO, an anomaly was found in the operation of the tertiary sewer network (red terciaria), apparently caused by the work performed for the Desvío del Colector Rivera near Dirección16 (…) When this diversion was made, a tertiary sanitary sewer network was left connected to the original Colector Rivera pipeline when it should have been connected to the Nueva Tubería (Desvío). This condition causes wastewater to stagnate and generate foul odors. Based on the field observations at Point A (see image), the wastewater collects in a manhole (pozo de registro), which fills until it reaches a point where the wastewater flows into the new pipeline; during this process, the wastewater becomes septic and generates foul odors (…) In view of the foregoing, and in order to safeguard public health and an ecologically balanced environment, it is requested that the corresponding measures be taken to resolve this problem so that the wastewater ceases to accumulate and flows properly (…)”.
Through official letter No. DRyT-OMSR-2024-00088 of February 19, 2024, the ICAA authorities informed and requested the following of the Municipalidad de Moravia:
“(…) As part of the inspections conducted to prepare the report requested by the Dirección Jurídica following the filing of the Recurso de Amparo – Expediente 24-002429-0007-CO, an anomaly was found in the culverting (entubamiento) of the Quebrada Rivera, on the east side of Parque Los Robles de Moravia. (…) At this site, a reduction in the stream’s cross-section was identified, which may cause the pipeline to lack sufficient capacity to convey the water during the rainy season (…) In view of the foregoing, it is requested that this condition be assessed and the corresponding work performed (…)”.
And through official letter No. DRyT-OMSR-2024-00089 of February 19, 2024, ICAA authorities informed the Director del Área de Salud de Moravia that, as part of the inspections conducted in connection with this amparo proceeding, several residences bordering Parque Los Colegios Norte were found to discharge their wastewater into the Quebrada Rivera. This was communicated so that the appropriate measures could be ordered to remedy the situation.
Furthermore, it was determined that, in connection with the amparo proceeding, on February 20, 2024, the authorities of the Área Rectora de Salud de Moravia conducted an inspection in the Colegios Norte de Moravia sector. That inspection produced the following findings:
“(…) At the site, we spoke with AyA officials who were conducting an inspection there. A joint inspection was conducted along the route of the new sewage pipeline (tubería de aguas negras) installed by AyA. They informed us that a ‘bypass’ had previously been operating but was disabled when the new pipeline at the site became operational; no foul odors were detected, and no sewage (aguas negras) was flowing from the ‘relief’ pipeline (tubería de ‘alivio’) into the stream. It was confirmed that residences are located within the stream’s protection area (área de protección), and the matter was therefore referred to MINAET (…)”.
Furthermore, official letter No. MS-DRRSCS-DARSM-068-2024 of February 21, 2024, signed by the Director del Área Rectora de Salud de Moravia, stated the following: According to the inspection conducted on February 20, 2024, no changes in the direction of the channel (cauce) of the quebrada Chiquita or Rivera, nor any debris, could be confirmed. Along a large portion of the channel between Parque del Norte and Dirección10, no foul odors, flies, or rodents were detected. During the inspection, ICAA officials explained that, in order to make improvements to the sanitary sewer system (acueducto sanitario), it was necessary to enable discharges into the stream, which were discontinued because the work had been completed. The pipe through which the water was discharged into the stream remained dry and was not releasing water into the stream.
Having analyzed all the foregoing, this Constitutional Court considers that this aspect of the petition must be granted.
For this purpose, it is important to note first that the right to a healthy and ecologically balanced environment must be made compatible with the principle of sustainable human development and the precautionary principle (principio precautorio) in environmental matters, from which arises the need to implement mitigation measures (medidas de mitigación) in situations that pose risks to the environment but are necessary for the purposes of human development and safety.
In this particular case, it was established that the initial actions of the ICAA authorities were consistent with that need for compatibility insofar as, faced with the risk clearly posed by the temporary discharge of sewage into the stream, they implemented a series of containment or mitigation measures alongside those actions for the purpose of containing the pollution and problems that clearly resulted from a situation of this kind (flushing the stream with pressurized clean water, applying bioremediation microorganisms, etc.).
Nevertheless, it must be taken into account that it was also established in this matter that those actions were insufficient, since inspections conducted by the ICAA authorities on February 17 and 18 of the current year (in connection with the filing of this amparo proceeding) determined that sewage was still present and flowing irregularly in the area of interest.
Specifically, it was established that in Colegios Norte (near the Parque) “(…) a tertiary sanitary sewer network was left connected to the original Colector Rivera pipeline when it should have been connected to the Nueva Tubería (Desvío) (…)”, which, according to the statement, “(…) causes wastewater to stagnate and generate foul odors (…)”. In addition, “(…) a significant change in the color of the water, from its natural transparent river-water appearance to the black color characteristic of septic water (…)” was observed at that site, and the situation was therefore brought to the attention of the Unidad Ejecutora de Agua Potable y Saneamiento (PAPS) of the ICAA for correction.
It was also determined that, because of the condition described above, sewage was flowing through the stream at Parque Los Colegios Norte. It was likewise confirmed that “(…) several properties bordering the Parque apparently discharge their wastewater into the stream (…)”; accordingly, an official letter was sent to the Ministerio de Salud so that it could conduct whatever investigations it deemed appropriate.
It was likewise verified that at Dirección10 “(…) the flow conditions remain as observed at Point III (…)”, that is, with sewage present.
In essence, it has therefore been demonstrated that in some sectors of the canton of Moravia, even though the aforementioned discharges into the stream have already ended, a problem caused by the flow and stagnation of sewage persists to date. That problem, in turn, has two sources: the aforementioned work performed by the ICAA and the conduct of certain residents who discharge their wastewater into the stream. This situation unquestionably constitutes a clear source of pollution and affects the health of local residents.
Furthermore, it must not be overlooked that the same inspection conducted by the ICAA determined that the stream—specifically near Dirección06—has a constriction (estrangulamiento) that may cause the pipeline to lack sufficient capacity to convey rainwater during the rainy season, a situation that could also affect the residents of that particular area. In view of the foregoing, as demonstrated, the ICAA authorities sent an official letter to the Municipalidad de Moravia so that it could assess that condition and perform whatever work it deemed appropriate.
At the same time, an additional matter must be considered: also as a result of the filing of this amparo proceeding, the authorities of the Área de Salud de Moravia conducted an inspection of the areas of interest on February 20, 2024, determining, among other things, that along “a large portion” of the channel between Parque del Norte and Dirección10, no foul odors, flies, or rodents were detected. This clearly leads to the conclusion that such sources of pollution are indeed present in some other sectors.
That said, it is evident that even though the claim concerning the failure to respond to the complaint filed on this matter was brought prematurely before the Chamber, this becomes irrelevant precisely because the respondent authorities were aware of the hazardous activity being carried out and, despite this, as established, failed to adopt, in a timely and effective manner, all the monitoring measures and inspections necessary to address the resulting contamination. The problem alleged by the petitioner persists, and it is thus evident that it was only because this proceeding was filed that the respondent authorities, particularly those of the ICAA, intervened and issued instructions to other internal units (Unidad Ejecutora PAPS), as well as to other public entities—the Ministerio de Salud and Municipalidad de Moravia—for the matter to be addressed and promptly resolved.
* Accordingly, because the constitutional right to enjoy a healthy and ecologically balanced environment, established in Article 50 of the Constitución Política, as well as the fundamental right to health enshrined in Article 21 of that same body of law, has been violated to the detriment of the petitioner and the other residents of the canton of Moravia, this amparo proceeding (proceso de amparo) must be granted with respect to these claims, with the consequences set forth in the operative portion of this judgment.
The petitioner also alleges that personnel from the Municipalidad de Moravia, while carrying out the project known as “Comprehensive Renovation and Beautification of the Parque de la Urbanización Colegios Norte,” dumped debris and soil into the watercourse (cauce), causing it to be diverted and, in certain areas, causing water to stagnate and retain sewage. He further claims that the municipality also disregarded this problem. He likewise alleges that the stream has encroached upon the easement areas (áreas de servidumbre) and setbacks (retiros), placing walls and homes at risk.
Having reviewed the record, this Chamber finds no grounds to grant this portion of the appeal. This is because, first, as stated above, the failure to respond to the complaint filed regarding this matter was alleged prematurely before this Chamber.
In any event, it must be taken into account that the Mayor of Moravia informed this jurisdiction, under oath—with due warning of the consequences provided for in Article 44 of the Ley de la Jurisdicción Constitucional—that “(…) the Municipality has removed the debris from the stream referred to (…)”. He further explained and stated that “(…) the erosion of river or stream watersheds (cuencas) is a natural phenomenon directly linked to flow velocities, which in recent years have been altered by the effects of climate change (…)”.
It should likewise be noted that, on 17 and 18 February 2024, the ICAA authorities conducted an inspection in the area concerned, namely Dirección01, during which, as reported, no debris was observed in the stream as alleged, and it was concluded that “(…) No debris was identified in the stream, nor were any hazardous flows identified that could affect the properties (…)”.
In addition, it must be noted that, under oath, the Director of the Área Rectora de Salud de Moravia informed this Chamber that “(…) 3. During an inspection conducted by officials of the Área Rectora de Salud Moravia on 20 February 2024 as a follow-up to the complaint, no changes could be identified in the direction of the watercourse of Quebrada Chiquita or Rivera, nor was any debris observed as claimed by the complainant (…)”.
Accordingly, no violation can be identified of the fundamental rights of the petitioner or of the other residents of the Moravia area with respect to these particular matters.
In another respect, the petitioner alleges that the authorities of the Municipalidad de Moravia have neither intervened nor repaired the retaining wall (muro de contención) that collapsed two years ago and is located at Dirección10, thereby endangering the residents of that area. He states that the only action taken by the municipality was to remove the debris and close the bridge, which residents had reported years earlier as being structurally compromised.
Having reviewed the record, it is deemed established that, as alleged, the existing retaining wall facing Quebrada Chiquita in the Dirección10 sector of Moravia was undermined, as was a vehicular/pedestrian bridge, due, among other factors, to encroachment upon the stream’s protected areas (áreas de protección) through residential construction and the high velocity of stormwater flow. It is likewise deemed established that, in response to this situation, the Municipalidad de Moravia has undertaken several actions since 2022 to provide an appropriate solution concerning the wall and the existing passageway in the Barrio El Carmen sector. These actions included closing off the area and commissioning a study and proposed response. With respect to the latter, it was established that in February 2023, pursuant to Direct Procurement No. 2022CD-000218-0003300001, INGEOTEC submitted to the Municipalidad de Moravia the geotechnical report and design for the project entitled “Topographic, Geotechnical, Hydrological-Hydraulic Studies and Design of Protective Works for Quebrada Chiquita, Dirección10 Sector.” This report specified the work or protective structures to be undertaken to remedy the situation described above, specifically at the bridge and along the banks, at a cost of 151 million colones.
However, it must be taken into account that, notwithstanding the aforementioned actions, as of the date this amparo proceeding was filed, the work identified by the company for the definitive resolution of the problem had not begun, nor had a probable start date been determined. On the contrary, in his report, the Mayor of Moravia merely stated that options for allocating resources were then being explored.
Thus, the failure to take decisive action to address the situation means that the danger and risk to which all persons traveling through the area have been exposed for months continues to exist, unquestionably causing serious harm to and infringement of their fundamental rights. It should further be noted that although the grievance concerning the failure to address the complaint filed in January 2024 on this matter was brought prematurely before this Chamber, as has repeatedly been stated, it has been established in this proceeding that the respondent municipality had been aware of the relevant situation many months earlier, specifically since at least 2022. Therefore, as has also been stated, it had been obligated since that time to take all appropriate steps to provide an effective and decisive solution to the problem. Because these latter actions have not been taken, this portion of the appeal must be granted, with the consequences set forth in the operative portion of this judgment.
In view of the foregoing, the appeal must be partially granted.
In environmental matters, it is the undersigned Justice’s view that, where the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the administrative litigation jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do consider the merits of a case when other rights of persons affected by the source of contamination are implicated, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Constitución Política), as occurs in this case, in which the petitioner states that the authorities of the Instituto Costarricense de Acueductos y Alcantarillados, as part of work performed in the canton of Moravia, diverted wastewater or sewage into Quebrada Chiquita, thereby causing severe contamination and adversely affecting the health of the residents of Dirección10, Dirección06, and Los Colegios Norte.
They further asserted that the new connections installed by the Instituto Costarricense de Acueductos y Alcantarillados have caused the sewer adjoining Quebrada Chiquita in Barrio El Carmen to overflow with sewage when it rains. They also asserted that the authorities of the Municipalidad de Moravia, during work performed at Parque Los Colegios Norte, dumped debris and soil into the stream’s watercourse, causing it to be diverted and, in certain areas, causing water to stagnate and retain sewage. Finally, it is alleged that the Municipalidad de Moravia has neither intervened nor repaired the retaining wall and bridge that collapsed and are located at Dirección10, thereby endangering residents of the area. The foregoing violates the right to enjoy a healthy and ecologically balanced environment and a dignified standard of living.
I.Although I agree with the majority of the Chamber that the appeal should be partially granted, I disagree as to the forum in which the enforcement phase (fase de ejecución) of this matter should be conducted, because the rules governing this constitutional jurisdiction lack adequate mechanisms for monitoring compliance with a judgment involving highly complex technical matters. In this case, this includes ensuring that, within six months from service of this judgment, all the problems identified and reported by the Instituto Costarricense de Acueductos y Alcantarillados during the inspections conducted on 17 and 18 February 2024 are fully resolved, particularly those concerning the contamination and harm suffered by the petitioner as a result of wastewater or sewage being diverted into Quebrada Chiquita, which, according to him, runs directly behind his home. By contrast, the provisions of the Código Procesal Contencioso-Administrativo governing enforcement (Article 155 et seq.) offer clear advantages, including the ability to require schedules, impose fines, determine liability, monitor stages of compliance, and so forth.
Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.
II.Now, although the present amparo proceeding (recurso de amparo) was also upheld with respect to the following grievances raised by the appellant: that the new connections made by the ICAA have caused the sewer adjoining Quebrada Chiquita, located in Dirección10, to overflow with sewage when it rains, and that the Municipalidad de Moravia has neither intervened nor repaired the collapsed retaining wall and bridge located in Dirección10, thereby endangering residents of the area, the fact remains that no subjective determination or specific identification of an individual was made regarding those claims. In this regard, it should be noted that the petitioner expressly refers to the residents of Dirección10 and Barrio Sagrado Corazón. Consequently, respectfully and from my perspective, it does not appear valid, on the basis of a generic reference to “residents of Barrio El Carmen and Barrio Sagrado Corazón,” for this Court to hear a claim concerning administrative inaction that more properly belongs before the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa). Ergo, I dissent and deny the amparo proceeding with respect to these grievances.
x.- Documentation submitted to the case file (expediente). The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the Court within a maximum period of 30 business days from the date notice of this judgment is served. Otherwise, any material not collected within that period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session number 27-11 of 22 de agosto de 2011, artículo XXVI, and published in the Boletín Judicial number 19 of 26 de enero de 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session number 43-12 held on 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
The proceeding is partially upheld (solely with respect to the established sewage contamination and the failure to repair the wall and the pedestrian-vehicular crossing located in Dirección10). Consequently, Hugo Guevara Sánchez, in his capacity as Director of the Área Rectora de Salud de Moravia del Ministerio de Salud; Roosevelt Alvarado Ramírez, in his capacity as Sub Gerente General del Instituto Costarricense de Acueductos y Alcantarillados; and Roberto Zoch Gutiérrez, in his capacity as Alcalde de Moravia, or whoever respectively holds those positions, are ordered to coordinate with one another as necessary, issue the pertinent orders, and carry out all actions within the scope of their authority so that, within a maximum period of SIX MONTHS—calculated from the date notice of this judgment is served—all the problems found and identified by the Instituto Costarricense de Acueductos y Alcantarillados during the inspections conducted on 17 y 18 de febrero de 2024 are fully resolved.
Roberto Zoch Gutiérrez, or whoever holds the position of Alcalde de Moravia in his stead, is likewise ordered to issue the pertinent orders and carry out all necessary actions so that, within a maximum period of TWELVE MONTHS—calculated from the date notice of this judgment is served—the work required to address the situation involving the wall and the pedestrian-vehicular crossing located in Dirección10 de Moravia is undertaken and completed. The respondent authorities are warned that, pursuant to artículo 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that he or she is required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The State, the Instituto Costarricense de Acueductos y Alcantarillados, and the Municipalidad de Moravia are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative court.
The amparo proceeding is denied with respect to the allegations concerning the work performed in Dirección30 by the respondent municipality and the resolution of the complaint filed on 11 de enero de 2024. Magistrado Salazar Alvarado adds a note. Magistrada Garro Vargas dissents with respect to the enforcement of this judgment and, pursuant to artículo 56 of the Ley de la Jurisdicción Constitucional, orders that enforcement take place before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules set forth in artículos 155 and following of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be forwarded so that proceedings to enforce this ruling may be initiated. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del cinco de abril de dos mil veinticuatro .
Recurso de amparo interpuesto por [Nombre01 001], cédula de identidad [Valor CED01], contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, el MINISTERIO DE SALUD y la MUNICIPALIDAD DE MORAVIA.
RESULTANDO:
Redacta el Magistrado Delgado Faith; y,
CONSIDERANDO:
El recurrente aduce vulnerados los derechos fundamentales por cuanto:
De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:
A. HECHOS RELACIONADOS CON LA CONTAMINACIÓN POR AGUAS NEGRAS Y OTROS:
“(…) Asunto: Notificación de desfogue de aguas residuales para la rehabilitación del Colector Rivera 2, entre los pozos 02-30A al 02-50A Proyecto Alcantarillado Sanitario Metropolitano/Paquete de obras COMECO Estimado Doctor, En el contexto de la Licitación Internacional N°2019LI-000011-PRI, para la construcción del paquete de obras denominado "Construcción y mejoras de colectores y subcolectores en las cuencas Rivera, Torres, María Aguilar y Tiribi", conocido como COMECO, del Proyecto Alcantarillado Sanitario Metropolitano del Instituto Costarricense de Acueductos y Alcantarillados (AyA), ejecutado por la empresa SADE, se contempla la rehabilitación por revestimiento interno de la tubería con manga de fibra de vidrio por método CIPP (Cured In Place Pipe), de algunos tramos de alcantarillado sanitario del Colector Rivera 2, ubicado margen derecha e izquierda de la quebrada Rivera en el Cantón Moravia.
Las actividades a desarrollar específicamente en el Rivera 2, se encuentran en el tramo comprendido entre los pozos 02-30A al 02-50A en el sector de Los Colegios Norte (Ver Figura 1), el pozo 02-30A ubicado a dentro del Liceo Emma Gamboa entrando por la Dirección09 y el pozo 02-50ª está ubicado a 200m Oeste de Supermercado Mayca en Llorente de Tibás dentro de la propiedad en el margen derecho de la Quebrada Rivera. Por el alto caudal que lleva este colector Rivera 2, diámetro Ø750mm y diámetro Ø900mm, por lo que es necesario construir provisionalmente un rebalse con una tubería de igual o mayor tamaño con descarga en la quebrada Rivera en el pozo 02 28 y 02 35, y de esta manera reducir el caudal para tener un control en los pozos a intervenir. La ubicación de referencia de las obras a desarrollar y las fotografías del sistema se muestran en las imágenes a continuación (…)
Es claro entonces que, con la rehabilitación de la tubería sanitaria, se pretende mejorar las condiciones de saneamiento, mejorar la integridad de la tubería y su vida útil, eliminar descargas existentes a cuerpo de agua, proteger las aguas superficiales y subterráneas aledañas, zonas ribereñas, y al mismo tiempo ir contribuyendo con la mejora gradual del caudal hacia la Planta de Tratamiento Aguas Residuales Los Tajos. Estas actividades están previstas iniciar el 21 de Diciembre 2023 y tendrán una duración estimada de tres meses, haciendo descargas temporales, puntuales e intermitentes, como medida de seguridad para laborar en seco, partiendo de la premisa técnica de la imposibilidad de hacer los desvíos de aguas residuales a pozos aguas abajo. Si existiera ampliaciones en este plazo, se informarán oportunamente. Es necesario mencionar que el Proyecto de Alcantarillado Sanitario Metropolitano, cuenta con Declaración de Conveniencia Nacional e Interés Público para los estudios y las obras del Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José a desarrollar por el Instituto Costarricense de Acueductos y Alcantarillados, bajo el Decreto Nº 36529- MINAET, y Decreto de Gradualidad donde se declara de interés público y necesidad social el diseño, financiamiento, ejecución, operación y mantenimiento de las obras requeridas para la recolección, el tratamiento y disposición final de las aguas residuales de tipo ordinario generados en los centros urbanos, bajo el Decreto Nº 32133-S.
Nos ponemos a su disposición en el sentido de si se requiriera alguna ampliación en el tema o visita de campo conjunta e inspeccionar los trabajos en ejecución. El contacto del Ingeniero Gerente de Obra del AyA es: Marcos David Valverde Gamboa cel. Telf01, correo electrónico: ...01 Y el contacto del Regente Ambiental: David Benavides cel. Telf02, correo electrónico: ...02 (…)” (ver prueba).
Concretamente, producto de esas diligencias, se determinó lo siguiente:
(…) I. Entre la Dirección11 y Dirección12, a la altura de Dirección06. Se realizó una inspección al sitio, donde se encontró que la red de alcantarillado sanitario funciona con normalidad. No se observaron obstrucciones o anomalías en su funcionamiento, o alguna evidencia que demuestre que la red haya vertido a la quebrada Rivera. Cabe mencionar que en este punto se observó que la quebrada tiene una condición de estrangulamiento que puede provocar que en época de invierno la tubería no tenga la suficiente capacidad para transportar las aguas de lluvia. Dado lo anterior se procederá a informar de esta condición al Municipio de Moravia mediante el oficio DRyT-OMSR-2024-00088.
II.Dentro del Parque Los Robles. El personal del AyA realizó una valoración del funcionamiento de la red de alcantarillado sanitario dentro del Parque Los Robles, y no se observó ningún indicio que demuestre que la red de alcantarillado haya tenido un problema reciente en su funcionamiento. En este punto la Quebrada Rivera se encuentra a una distancia considerable, además de estar entubada, por lo que se considera que en este lugar no ha presentado alguna condición que conlleve que las aguas residuales descarguen a la Quebrada.
III.Los Colegios Norte que en las inmediaciones del Parque ubicado entre Dirección09 y Dirección13. En este punto se ha identificado que una tubería principal del AyA fue desviada (Colector Rivera), en apariencia como parte de los trabajos del Proyecto de Mejoramiento Ambiental, a través de la Unidad Ejecutora Programa de Agua Potable y Saneamiento (PAPS). Al realizar este desvío, se dejó una red terciaria sanitaria conectada a la tubería original Colector Rivera cuando se debió dejar conectada a la Nueva Tubería (Desvío). Es condición hace que las aguas residuales se estanquen y generen malos olores. Por lo observado en el campo en el punto A (ver imagen), las aguas se almacenan en un pozo de registro, el cual se va llenando hasta alcanzar un punto donde vierten a la nueva tubería, durante este proceso las aguas se tornan sépticas y generan malos olores. Se requiere mencionar que en el momento de visita no se observaron que las aguas residuales estuvieran descargando a la Quebrada Rivera. Sin embargo se observó un cambio significativo en el color del agua, pasando de una transparente natural de agua de río, a un color negro propio de una agua séptica. En vista de lo anterior, mediante memorando DRyT-OMSR-2024-00087 se procede a informarle a la Unidad Ejecutora PAPS, para que procedan a corregir esta condición en forma inmediata.
IV.El Parque de Los Colegios Norte En este sitio se observó que la red de alcantarillado sanitario funciona con normalidad no se identificaron anomalías en el funcionamiento de esta. Sin embargó, dada la condición mencionada en el punto III, la quebrada se muestra con un flujo de aguas negras. Adicionalmente, se observó que varias propiedades que colindan con el Parque aparentemente descargan sus aguas residuales a la quebrada. Dado lo anterior, mediante oficio DRyT-OMSR-2024-00089 se procede a informar de esta condición al Ministerio de Salud para que proceda a realizar las investigaciones correspondientes. Por último, se requiere mencionar que en este sitio no se observó escombros en la quebrada.
V.Dirección10, ubicado en la Dirección14, detrás de AutoPits En este sitio, la red de alcantarillado sanitario funciona con normalidad, no se detectaron anomalías en el funcionamiento de esta. En lo que respecta a la Quebrada, no se observan descargas que provenga de la red sanitaria administrada por el AyA, sin embargo, las condiciones del flujo se mantienen tal como se observaron en el Punto III. No se observaron condiciones en el caudal que puedan llegar a afectar las propiedades, pero esto es una condición propia de la época seca.
4. Labores realizadas por la Dirección de Recolección y Tratamiento GSGAM. Se considera importante mencionar que la Dirección de Recolección y Tratamiento GSGAM, no ha realizado, planificado o coordinado, el desarrollo de obras de inversión en este sector de Moravia, que vengan a generar problemas de malos olores o provoquen contaminación a la Quebrada Rivera. Como parte de las labores de investigación para la conformación del presente informe se identificó un punto donde se modificó el funcionamiento de la red de alcantarillado sanitario. Se procede a solicitarle a la Unidad Ejecutora del Proyecto PAPS, que corrija la condición encontrada en el Punto III, se le solicita a la Municipalidad valorar la condición de la Quebrada en el Punto I y se le informa al Ministerio de Salud de las descargas encontradas en el Punto IV.
5. Conclusiones 1. A razón de la información aportada por el recurrente, se identificaron 5 puntos donde se denuncia una problemática en el funcionamiento de las aguas residuales. 2. Se procedió a realizar visitas a los sitios identificados encontrado a que en ninguno de estos se haya encontrado que las aguas residuales estén vertiendo a la Quebrada Rivera. Cabe mencionar que esta condición pudo haber ocurrido en el pasado, pero en el momento de la visita no se observó. 3. En uno de estos puntos se identificó un defecto en el funcionamiento de la red de alcantarillado sanitario, por lo que se procedió a solicitarle a la Unidad Ejecutora PAPS la intervención inmediata. 4. No se identificaron escombros en la Quebrada o caudales peligrosos que lleguen a afectar las propiedades. Por lo contrario, el bajo nivel del flujo de la Quebrada genera que las aguas sépticas se estanquen a partir del Punto III. Cabe mencionar que esta condición en el caudal es propia de la época seca (…)” (ver informe y prueba).
B. HECHOS RELACIONADOS CON EL MURO DE CONTENCIÓN (SECTOR BARRIO EL CARMEN).
“(…) 4.8 Evaluación de resultados y conclusiones • Las obras de protección requeridas se ubican en el Barrio El Carmen, del Distrito 01 San Vicente, del Cantón 14 Moravia, de la Provincia 01 San José, en las coordenadas Dirección17– proyección CRTM 05, sobre la Quebrada Chiquita. • La Quebrada Chiquita es una afluente de la Quebrada Rivera (gran cuenca del Río Virilla). Este cauce manifiesta las condiciones de una acequia colectora de vertidos pluviales de los poblados colindantes. Está altamente invadida en su área de protección, que corresponde a la franja de 10 metros a partir de la ribera del cauce, según lo estipulado por la Ley Forestal Nº7575, Artículo 33. El área de protección es irrumpida por construcción de tapias y muros de retención. • Actualmente en el sitio hay un puente, constituido por una losa de concreto con un peralte de aproximadamente 40 cm, con estribos de concreto.
El puente tiene una luz de 3 metros y una altura libre de 5 metros. Inmediatamente aguas abajo del puente se constituye una grada o desnivel con una altura de 1,8 metros aproximadamente. El lecho está constituido por suelo altamente compactado y consolidado. • La elevada velocidad del flujo de agua, sumado al desnivel del lecho, ha provocado una acelerada socavación del cauce, poniendo en riesgo la obra de puente, y márgenes de la Quebrada. • La cuenca hidrográfica del Quebrada Chiquita (afluente de la quebrada Rivera) posee un área de 0,93 km2 , y una longitud de cauce de 2,4 km. La elevación máxima de la cuenca evaluada está definida en la elevación 1 245 msnm, y la cota mínima es la 1189 msnm definida en el paso vehicular sobre la Quebrada Chiquita. • La superficie de la cuenca está conformada mayoritariamente por desarrollo urbano/comercial. (…) Para cumplir con lo señalado, se propone un puente con una luz de 4,9 metros, una altura media de 3,6 metros libres con respecto a la cota base 1199 msnm, y un peralte de 0,50 m. Lo anterior, permite un borde libre de 1,0 m. (…) Dado que la quebrada ya manifiesta socavación muy agresiva en el área de estudio, se da por sentado que hay socavación general y en las pilas de los bastiones que pueda afectar las obras existentes. Señalado lo anterior, será necesario de implementar obras de protección contra socavación, tanto en los estribos del nuevo puente, como en el lecho y en ambas márgenes.
Para lograr esto, la propuesta incluye las siguientes medidas: • Demolición del puente existente, e implementación de un nuevo puente con las medidas indicadas en el párrafo anterior. • Excavación y conformación de sección transversal del cauce a partir de la Dirección18 cuya elevación de fondo será la 1 199 msnm, hasta la sección del puente.
• Losa de concreto ciclópeo, o concreto lanzado, en el lecho del cauce desde la Dirección19 hasta la Dirección20. No se requiere concreto reforzado, dado que, para las nuevas condiciones del cauce, la velocidad del agua oscila entre 4 y 6 m/s. Concreto reforzado se recomienda para velocidades mayores a 10 m/s. • Muro lateral en ambas márgenes desde la Dirección19 hasta la Dirección20. Se recomienda implementar concreto lanzado con pernos de anclaje, por la dificultad del sitio para implementar otro método constructivo. (…) • El delantal a la salida tendrá una longitud de 7,5 metros, con gradas o desniveles a cada 2,5 metros y una altura de 0,5 m. El delantal se recomienda de concreto ciclópeo (…)
8. COSTO DETALLADO DE SOLUCIÓN PROPUESTA (…) ₡ 151 087 397,85 (…)” (ver informe y prueba).
C. HECHOS RELACIONADOS CON LA DENUNCIA PLANTEADA POR LOS VECINOS AFECTADOS.
“(…) Desde las presuntas recientes obras realizadas por Acueductos y Alcantarillados en la red de alcantarillado en Moravia e incluyendo los trabajos realizado a la altura de la naciente de la quebrada conocida como Chiquita o Rivera, ubicado frente al Parque Los Robles, incluyendo además las obras realizadas por la Municipalidad de Moravia en el parque de Los Colegios Norte, se ha generado una problemática constante y significante en relación con el sistema de alcantarillado, provocando malos olores a cloaca que han afectado de manera constante la calidad de vida de los habitantes, provenientes de dicha quebrada (…) Esta problemática se ha vuelto cada vez más grave, causando molestias a toda la comunidad y lesionando directamente nuestro derecho fundamental a disfrutar de un ambiente sano y ecológicamente equilibrado (…) Esta denuncia consta de tres aspectos principales.
Primero: Dirección10, malos olores y problemas de alcantarillado: Hace varias semanas, tras las obras realizadas por Acueductos y Alcantarillados en las inmediaciones del Parque Los Robles y de los Colegios Norte en Moravia, se ha intensificado el olor a cloaca de manera constante las 24 horas del día, siendo aún más perceptible durante la noche y madrugada. Estos olores penetran en nuestras viviendas, afectando la calidad del sueño y la salud de todos los residentes, incluyendo niños, adultos y personas mayores, al punto que se han reportado brotes de diarrea dentro del Barrio El Carmen, ubicado en la Dirección21, detrás de AutoPits. Además, el bajo caudal en la quebrada ha generado la acumulación y estancamiento de aguas negras, produciendo olores nauseabundos y atrayendo plagas, lo cual representa un riesgo para la salud de la comunidad. Dicho problema nunca se habla presentado dentro de esta comunidad.
Se denuncia adicional a esto que en este punto, hace dos años colapsó el muro de contención por lo que no ha habido ¡intervención para rehacer esto y volver a poner malla, existiendo un peligro inminente de lesiones serias para los habitantes. De caer una persona cauce, no solo existe el problema de la altura que puede causar lesiones serias, si no que también de caer en las aguas contaminadas con cloaca, estas que también presentan un riesgo grave ante la exposición para la salud. Se hace notar que en días previos cayó el perro de una vecina en el cauce, para rescatarlo ingresó un vecino que es adulto mayor quien expuso su integridad y denuncia también el estado de la quebrada. (…)
Problemas en el sistema de alcantarillado: Las presuntas nuevas conexiones realizadas por Acueductos y Alcantarillados habrían provocado que, cuando llueve, la alcantarilla que colinda con la quebrada Chiquita/Rivera ubicada en Dirección14, Barrio el Carmen, se rebase el agua; en este mismo punto es importante señalar que los vecinos han reportado que en horas de la madrugada y horas de la mañana, y en este caso sin llover, desaguan presuntas aguas negras a presión y converge con las aguas negras que trae la quebrada Chiquita. En otras palabras, esta alcantarilla no solo recoge agua pluvial, sino que también aguas negras de algún otro sector. Adicionalmente, el rebosamiento de dichas aguas a presión de la alcantarilla impacta el muro de un vecino, el cual ya le ocasionó daños que pueden comprometer su vivienda debido a las nuevas conexiones al alcantarillado, mismo que colapsa cuando llueve.
A pesar de reportar esta situación por varios vecinos, cuando colapsó el muro de contención de la quebrada, no se ha tomado ninguna acción para corregir este problema por parte de las entidades gubernamentales, lo que agrava aún más la situación. La única acción que tomó la municipalidad fue de "limpiar" los escombros y clausurar el puente sobre el cual los vecinos ya habían denunciado años atrás y de manera constante que está falseado (…) Solicitamos de manera urgente y encarecidamente su pronta intervención y atención a esta problemática, buscando una solución integral que resguarde nuestros derechos fundamentales y promueva un ambiente sano y seguro para todos los habitantes de la comunidad, tal como lo establece la constitución política en los artículos mencionados previamente. Es un peligro inminente que alguien caiga dentro de la quebrada por falta de muro de contención y malla, además que se le suma el agravante peligro inminente a la salud porque esta se encuentra llena de agua estancada con cloacas. Se adjuntan imágenes probando esto.
Segundo: Denuncia Barrio Sagrado Corazón: Se nos ha comunicado lo siguiente por parte de otros vecinos: 1. Que, con respecto a la quebrada Chiquita, a la altura del puente de la Dirección03, ubicado en la Dirección13, entre Dirección22, el agua se encuentra¿ un poco limpia, pero que después de los Condominios Topacio y el nuevo Tramontal, cuando se pasa por el puente de Dirección23 (El Bajillo), ubicado en Dirección09, entre las Dirección24, ya el agua baja completamente contaminada con aguas negras porque estas fueron desviadas y caen sobre la quebrada Chiquita. a. Adicional a esto, desde hace un parde meses, Acueductos y Alcantarillados realizó obras en las inmediaciones del Parque Los Robles, donde nace dicha quebrada Chiquita o también conocida como Rivera. Como referencia, esta nace entre la Dirección11 y Dirección12. 2. Acueductos y Alcantarillados realizó trabajos a la altura de Barrio Sagrado Corazón y presuntamente necesitaban trabajar con tuberías secas, por lo que desviaron ciertas aguas servidas a la quebrada. Ver anexo lll. El peligro a la salud pública es un tema fundamental que hay que ponerle atención ya que estas aguas contienen bacterias que pueden generar infecciones bacterianas, virales, infecciones por parásitos, etc. Los vecinos reportan brotes de diarrea, los cuales muy probablemente el origen sea por estas aguas.
Tercero: Denuncia Colegios Norte: Cauce con aguas negras, obras sin permisos en el cauce que generaron cambio de dirección y generaron daños a los muros de los vecinos. Se reporta por parte de los vecinos de Los Colegios Norte que en las inmediaciones del parque ubicado entre Dirección09 y Dirección13, mismo por el cual pasa dicha quebrada, que los olores a cloaca persisten las 24 horas también posterior a los presuntos trabajos realizados por Acueductos y Alcantarillados. No solo se reporta olores, se reporta la presencia de aguas jabonosas. En este punto es donde vecinos reportan que personal Municipal, de manera negligente y dolosa, durante la ejecución de las obras denominadas "Remodelación Integrar y Embellecimiento del parque de la Urbanización Colegios Norte", bajo el contrato OC 931925, tiró escombros y tierra sobre el mismo cauce, el cual como consecuencia desvió el cauce y generó también que, en ciertas partes, el agua se estanque, reteniendo aquí aguas negras.
Este hecho está documentado y se respalda con videos adjuntos en las llaves tipo USB, en donde inclusive se llamó a la Fuerza Pública ese día, sin embargo, la Municipalidad procedió con sus obras. Como consecuencia de esto también se generó un perjuicio directo que afectó a los vecinos cuyas propiedades colindan con este cauce, consumiendo así la quebrada las áreas de servidumbre/retiro y poniendo en peligro los muros y viviendas. Como observación, esto también sucedió en Dirección10 hace años al entubar el cauce, desviando así el mismo, generando que la misma quebrada cambiase el cauce y dañando y consumiendo la servidumbre/retiros de los muros de los vecinos (…)”. En tal gestión se indicaron los siguientes correos electrónicos como medios de notificación: ...03 y ...04 (ver prueba).
“(…) En atención a la nota remitida el 11 de enero de 2024, por parte de vecinos de Dirección25, Dirección06 y Dirección26 de San Vicente de Moravia, se extiende la presente con el fin de referirnos puntualmente a lo señalado en dicha nota: El Instituto Costarricense de Acueductos y Alcantarillados (AyA) construye el sistema de alcantarillado sanitario mediante el Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José (AMSJ), en 11 cantones de la provincia, el cual tiene como propósito mejorar las condiciones ambientales y de salud pública de la población mediante la rehabilitación y ampliación de la cobertura del sistema del alcantarillado sanitario existente en el AMSJ, así como mediante la operación de la planta de tratamiento para las aguas residuales provenientes de este sistema. El Proyecto de Mejoramiento Ambiental, es declarado de Conveniencia Nacional e Interés Público mediante el Decreto 3652, en abril 2011.
Debido a los efectos de contaminación que se concentran en la parte baja de la cuenca del Río Tárcoles, es que la Municipalidad de Puntarenas, la Defensoría de los Habitantes y el partido Garabito Ecológico presentaron el 19 de agosto de 2004 un recurso de amparo ante la Sala Constitucional. Esta emitió el voto constitucional número 5894-07, a través del cual se obliga a todas las instituciones públicas incluyendo al Instituto Costarricense de Acueductos y Alcantarillado (AyA), tomar de inmediato las acciones necesarias para eliminar los focos de contaminación que existen a lo largo de la cuenca del río Grande de Tárcoles y restaurar el daño ambiental ocasionado en la misma. Actualmente se encuentra en ejecución el Contrato de la Licitación Pública Internacional 2019LI-000011-PRI denominada “Construcción y mejoras de Colectores y subcolectores en las cuencas Rivera, Torres, María Aguilar y Tiribí” cantones San José, Goicoechea, Montes de Oca, Vázquez de Coronado, Moravia, Desamparados, Alajuelita y Tibás, Provincia San José, la cual considera dentro de su alcance contractual la extensión del alcantarillado sanitario en el sector norte del casco central de San José.
Es importante mencionar que, debido al impacto de las obras, el proyecto realiza un abordaje social donde se realizan acciones tales como: • La empresa Contratista cuenta con un plan de abordaje social que es aprobado y supervisado por la Inspección, apoyo y coordinación Social y de Comunicación de la Unidad Ejecutora de AyA. En este plan se establecen acciones sociales que se realizan antes, durante y al finalizar las intervenciones a lo largo de toda la obra en las zonas a intervenir. • Se realiza un levantamiento de actores sociales: empresas, instituciones, comercios y cualquier otro actor que se considere pertinente, con el fin de recopilar datos de contacto, para mantener una comunicación constante de las diferentes etapas del proceso constructivo. • El AyA mantiene un equipo de Gestores Sociales como apoyo en las coordinaciones y situaciones que se presenten en las áreas de impacto de las obras.
Aparte de lo mencionado, se destaca que se han ejecutado labores como: 1. Reuniones con actores sociales como asociaciones de desarrollo, instituciones como Municipalidad de Moravia y Área Rectora de Salud. (…) 2. Se han realizado acciones de comunicación por volanteo, distribución de información por correo electrónico, grupos de mensajería (WhatsApp) y perifoneo para informar sobre las obras. (…) Antecedentes a la denuncia interpuesta por parte de los vecinos: Anteriormente, se ha tenido en el Parque Municipal de Los Robles, rebalses de un pozo sanitario en época lluviosa debido a las conexiones ilegales de las aguas pluviales de las viviendas al sistema de alcantarillado sanitario; donde se ha aclarado que las aguas pluviales deben correr por los caños y hasta el río porque en principio no son aguas contaminadas y separarlas de las aguas residuales, las cuales deben correr por el colector del sistema sanitario del AyA y hacia la Planta de Tratamiento Los Tajos para su adecuado tratamiento.
Respecto a las situaciones de un rebalse de aguas provenientes del alcantarillado sanitario, cabe mencionar que esta situación se presenta cuando hay lluvias de fuerte intensidad debido a las conexiones ilícitas de las aguas pluviales al sistema sanitario en el área de influencia de dicho sistema, lo que ha generado el rebalse de algunos pozos. Sin embargo, la Institución ha realizado varias mejoras importantes como parte de las obras sanitarias en ejecución en el sector, desde el sector del estadio Luis Ángel “Pipilo” Umaña, pasando por el Parque Los Robles (Dirección27) hasta el cruce de la Dirección13 y Dirección12 (pozo 2-23A), que han mejorado las condiciones en el lugar, de las cuales se pueden mencionar: • Reemplazo de la tubería existe, ampliándola de 450mm a 600mm de diámetro, lo que implica mayor capacidad hidráulica. • En ese mismo sector, se evidenció la presencia de una obstrucción severa de la tubería por raíces y residuos que provocaba una disminución de aproximadamente un 90% de la capacidad de la tubería, lo que incrementaba la problemática de los rebalses, por lo que se procedió a realizar una limpieza de la tubería por medios robóticos.
Cabe mencionar que en todo este sector ya existían aportes a la quebrada Chiquita, debido a la antigüedad y daños de la tubería antigua, y es precisamente con este proyecto de alcantarillado sanitario del AyA, que viene a eliminar estas descargas al cuerpo de agua. Así mismo, esta tubería actualmente está siendo reemplazada desde Los Robles hasta Los Colegios Norte, lo que ayudará en gran medida a eliminar estos rebalses, pero la solución definitiva de estos rebalses no está en manos de AyA, sino que debe ser una labor que involucra a varias Instituciones y que debe ser liderada por el Ministerio de Salud, ya que esta institución es quién tiene la potestad de inspeccionar las viviendas, así como de emitir órdenes sanitarias para que se corrijan las conexiones pluviales que descargan en el alcantarillado sanitario o viceversa. Lo mismo sucede con uno de los videos presentados en la denuncia de El Carmen específicamente en el Dirección28, donde es necesaria la acción conjunta interinstitucional junto con las obras que aún quedan por ejecutar en el sector.
En la nota enviada por parte de los vecinos se hacen cuatro solicitudes, por lo que a continuación se brinda respuesta a las que corresponden específicamente con el Proyecto de Alcantarillado Sanitario del AyA: • Solicitud de los vecinos en la denuncia de inspección del cauce para detener el vertido de aguas residuales y que se tomen las medidas para eliminar la contaminación de la Quebrada Chiquita (solicitudes 2 y 3). Se debe aclarar que para ejecutar las obras de alcantarillado sanitario que van desde Los Robles y hacia Los Colegios Norte, fue necesario contar con una descarga controlada, puntual y por un tiempo determinado, donde se desvió temporalmente el caudal de la red sanitaria a la quebrada Chiquita, e informando de las obras al Ministerio de Salud con una nota enviada el 21 de diciembre del 2023 con la descripción y justificación de los trabajos: “Por el alto caudal que lleva este colector Rivera 2, diámetro Ø750mm y diámetro Ø900mm, por lo que es necesario construir provisionalmente un rebalse con una tubería de igual o mayor tamaño con descarga en la quebrada Rivera en el pozo 02-28 y 02-35, y de esta manera reducir el caudal para tener un control en los pozos a intervenir.
La ubicación de referencia de las obras a desarrollar y las fotografías del sistema se muestran en las imágenes a continuación” (…) La nota presentada al Ministerio de Salud se adjunta en el anexo 1 (A1.) del presente documento. Adicionalmente, se tuvieron reuniones con actores sociales antes de que iniciaran as obras del proyecto en el sitio para informar de las intervenciones: • Reunión en la Municipalidad de Moravia con el Ministerio de Salud y la Asociación de Desarrollo Integral de Los Robles el día 07 de julio del 2022. (…) • Reunión con la Municipalidad de Moravia y el Área Rectora del Ministerio de Salud de Moravia para informar sobre los trabajos y obras a ejecutar donde este proyecto (incluido el rebalse mencionado anteriormente). Esta reunión fue el 25 de enero del 2023 en las oficinas del Ministerio de Salud de Moravia. (…) Actualmente no existen vertidos de aguas residuales a la quebrada, se logró reemplazar satisfactoriamente la tubería del colector.
Ahora bien, con relación al vertido realizado en días pasados, cabe mencionar las medidas de mitigación que se han tomado: 1. Durante los días que se tuvo el rebalse, se atendió a los vecinos y se realizaron lavados de la quebrada con agua limpia a presión desde tanquetas y cisternas. (…) 2. Monitoreo constante por parte de los gestores ambientales tanto de la empresa Contratista como de la Inspección Ambiental de AyA, con el fin de determinar los mejores sitios para poder hacer la aplicación de agua limpia. 3. Como medida de apoyo, mitigación y para las mejoras de la condición de la quebrada, el pasado viernes 26 de enero se realizó una aplicación de microorganismos biorremediadores, con el fin de bajar la carga orgánica y los malos olores presentes en diversas partes del cuerpo de agua (Anexo 7).(…) Cabe destacar que, durante las inspecciones y visitas realizadas a la quebrada Chiquita, se evidencian los aportes de aguas residuales de tuberías adyacentes a viviendas de vecinos que contaminan aún más el agua superficial.
Esto evidentemente es ajeno al proyecto, pero genera una importante carga contaminante sobre la quebrada. (…) Es claro entonces que, con el reemplazo de la tubería sanitaria y la mejora integral del sistema sanitario en el sector, se pretende recuperar las condiciones de saneamiento de la quebrada Chiquita, así como proteger las aguas superficiales y subterráneas aledañas, zonas ribereñas y al mismo tiempo ir contribuyendo con la mejora gradual del caudal hacia la Planta de Tratamiento Aguas Residuales Los Tajos, eliminando precisamente las descargas o fuentes crudas de aguas residuales. (…) Quedamos a las órdenes si consideran necesario alguna aclaración adicional, y nos ponemos a su disposición para cualquier visita o reunión conjunta (…)” (ver prueba).
El recurrente aduce que se interpuso una denuncia ante las autoridades recurridas el pasado 11 de enero de 2024, mediante la cual se hizo alusión a la contaminación producida en algunos sectores de Moravia por aguas negras, así como lo tocante al colapso de un muro de contención y puente. Sin embargo, acusa que, a la fecha de formulado este amparo, dicha denuncia no había sido resuelta.
Para resolver este agravio en particular y conocerse por el fondo, debe aclararse, en primer término, que, a partir de la Sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones–, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción –respaldado por la mayoría de este Tribunal Constitucional–, pues se está ante denuncias presentadas por contaminación ambiental, las cuales presuntamente no han sido resueltas dentro de un plazo razonable.
Aclarado el punto, este Tribunal observa que este extremo del recurso en particular merece ser desestimado. Lo anterior, en el tanto se observa que, para el día de planteado este proceso de amparo, sea, el 29 de enero de 2024, no había transcurrido un plazo excesivo e irrazonable para la atención y resolución de la denuncia que había sido formulada tan solo el 11 de enero del año en curso, es decir, escasos dieciocho días previos.
De este modo, resulta claro que las partes recurridas –para el día de planteado el presente proceso–, contaban con plazo para pronunciarse formalmente sobre la denuncia bajo estudio. Así las cosas, se estima que el amparo, en cuanto a este extremo resulta prematuro y, por ende, al no verificarse el quebranto a derecho fundamental alguno, deviene menester su desestimatoria.
En todo caso, debe observarse que se ha demostrado que mediante nota de 29 de enero de 2024 (notificada a los interesados en fecha no precisa), las autoridades del ICAA se pronunciaron sobre dicha denuncia y brindaron respuesta.
El recurrente, aduce que las autoridades del ICAA, como parte de obras realizadas en el Cantón de Moravia, procedieron a desviar aguas servidas o negras hacia la Quebrada Chiquita, produciendo con esto una grave contaminación y afectación a la salud de los vecinos de Dirección10, Dirección06 y de Los Colegios Norte. Asimismo, acusa que las nuevas conexiones hechas por el ICAA han provocado que, cuando llueve, la alcantarilla que colinda con la Quebrada Chiquita ubicada en Barrio El Carmen, se rebase con aguas negras también.
Revisados los autos, se tiene por demostrado que las autoridades del ICAA tienen a cargo el denominado Proyecto de Alcantarillado Sanitario Metropolitano que tiene como objetivo “Mejorar las condiciones que presentan hoy día los ríos y el medio ambiente del Área Metropolitana de San José, causadas por las descargas de las aguas residuales sin tratamiento, mediante la rehabilitación y expansión del sistema de alcantarillado sanitario y la construcción de una planta de tratamiento”. Lo anterior, se tiene proyectado lograr, según se acreditó, mediante la rehabilitación y ampliación de la cobertura del alcantarillado sanitario existente en el Área Metropolitana, así como mediante la incorporación de una planta de tratamiento para las aguas residuales provenientes de este sistema, la cual fue inaugurada en el año 2015.
Consta que, para ejecutar dicho proyecto, se emitió la Licitación Pública Internacional No. 2019LI: “Construcción y Mejoras de Colectores y Subcolectores en las cuencas Rivera, Torres, María Aguilar y Tiribí”. Además, se demostró que las obras referentes a dicho proyecto tienen de sustento en los siguientes decretos y resoluciones : - Resolución No. 852-2001 SETENA de 13 de diciembre de 2001, mediante la cual la Secretaría Técnica Nacional Ambiental aprobó el Estudio de Impacto Ambiental para el proyecto "Alcantarillado Sanitario Metropolitano" y el anexo del proyecto - Decreto No. 32133-S de 7 de diciembre de 2004 que declara de interés público y necesidad social el diseño, financiamiento, ejecución, operación y mantenimiento de obras para la recolección, tratamiento y disposición final de aguas residuales, generados en centros urbanos. -Resolución No. 460-2005-SETENA de 3 de marzo de 2005 donde se aprobó modificaciones del Estudio de Impacto Ambiental para el proyecto "Alcantarillado Sanitario Metropolitano". - Decreto Ejecutivo No. 36529-MINAET de 14 de abril de 2011 que corresponde a la Declaración de Conveniencia Nacional e Interés Público los estudios y las obras del Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José a desarrollar por el Instituto Costarricense de Acueductos y Alcantarillados. -Resolución 503-2016-SETENA de 15 de marzo de 2016 donde se avaló la actualización del Plan de Gestión Ambiental, componente Colectores (sector norte y sector sur) del proyecto Alcantarillado Sanitario Metropolitano. -Plan de Gestión Ambiental para la construcción y rehabilitación de colectores y subcolectores sectores norte y sur, proyecto alcantarillado sanitario metropolitano.
En adición a lo anterior, se tiene por demostrado que el ICAA, como parte del supra citado proyecto, ha venido realizado obras de alcantarillado sanitario para su mejora, desde Los Robles hasta Los Colegios Norte (sectores que pertenecen al cantón de Moravia). Para ejecutar tales trabajos, el ICAA tiene contratada a la empresa SADE Compagnie Générale De Travaux D’ Hydraulique (mediante la referida licitación pública internacional 2019LI-000011-PRI), cuyos trabajos iniciaron en abril del 2021 y terminarán a finales del 2024.
Consta también que, para llevar a cabo las citadas obras de alcantarillado sanitario (concretamente reemplazos de tubería sanitaria), las autoridades del ICAA dispusieron originalmente realizar, durante tres meses y, a partir del día 21 de diciembre de 2023, una descarga controlada y puntual del caudal de la red sanitaria a la Quebrada Chiquita.
En virtud de lo anterior, se demostró que se llevó a cabo previamente un abordaje social, a través de las siguientes acciones: 7 de julio de 2022 (reunión en la Municipalidad de Moravia con el Ministerio de Salud y la Asociación de Desarrollo Integral de Los Robles); 25 de enero de 2023 (reunión en las oficinas del Ministerio de Salud de Moravia con la Municipalidad de Moravia, para informar sobre los trabajos a ejecutar); 4 de septiembre de 2023 (reunión entre funcionarios del ICAA y personeros del Liceo Laboratorio Emma Gamboa); se han realizado acciones de comunicación por volanteo y distribución de información por correo electrónico, grupos de mensajería (WhatsApp) y se han ejecutado acciones de comunicación por perifoneo para informar sobre las obras.
Asimismo, consta que, para llevar a cabo las anteriores descargas, el ICAA informó al Director del Área Rectora de Salud de Moravia, a través de nota enviada el 21 de diciembre de 2023 (con la descripción de los trabajos a realizar y su justificación). Entre otros aspectos, en esta nota se informó que, para lograr el cometido del proyecto, era necesario “(…) construir provisionalmente un rebalse con una tubería de igual o mayor tamaño con descarga en la quebrada Rivera en el Dirección29, y de esta manera reducir el caudal para tener un control en los pozos a intervenir (…)”.
Se demostró también que, durante los días en que se realizaron tales descargas, el ICAA ejecutó varias medidas de mitigación para disminuir los inconvenientes que se pudieran ocasionar, a saber: 1. Durante los días que se tuvo la descarga, se atendió a los vecinos para explicar los alcances de los trabajos que se realizaban. 2. Se realizaron lavados de la quebrada con agua limpia a presión desde tanquetas y cisternas. 3. Se realizó monitoreo constante por parte de los gestores ambientales tanto de la empresa contratista como de la Inspección Ambiental de ICAA, con el fin de determinar los mejores sitios para poder hacer la aplicación de agua limpia. 4. El viernes 26 de enero de 2024 se realizó una aplicación de microorganismos biorremediadores, con el fin de bajar la carga orgánica y los malos olores presentes en diversas partes del cuerpo de agua. Se informó adicionalmente que estas últimas autoridades, ante la falta de lluvias en el sector de Moravia, continuaron realizando labores de biorremediación y la aplicación de lavados semanales de la quebrada con agua limpia a presión desde tranquetas y cisternas.
Se informó bajo juramento, que para el día 29 de enero de 2024 (fecha de interpuesto este amparo) “(…) ya no se tenían vertidos controlados de aguas residuales en la quebrada, por cuanto se logró reemplazar satisfactoriamente la tubería del colector (…)”.
En adición a lo anterior, se determinó que, los días 17 y 18 de febrero de 2024, con motivo de la interposición de este amparo, las autoridades del ICAA realizaron una serie de inspecciones en las mencionadas zonas de Moravia con el fin de “(…) valorar las condiciones de la red de alcantarillado sanitario administrada por el AyA, determinando correcciones que deben ser realizadas por el Gobierno Local, acciones que debe realizar el Ministerio de Salud (realizar las investigaciones para girar ordenes sanitarias a algunos vecinos) y correcciones que debe implementar la Unidad Ejecutora PAPS (…)”.
Concretamente, producto de esas diligencias, se determinó lo siguiente:
“(…) I. Entre la Dirección11 y Dirección12, a la altura de Dirección06. Se realizó una inspección al sitio, donde se encontró que la red de alcantarillado sanitario funciona con normalidad. No se observaron obstrucciones o anomalías en su funcionamiento, o alguna evidencia que demuestre que la red haya vertido a la quebrada Rivera. Cabe mencionar que en este punto se observó que la quebrada tiene una condición de estrangulamiento que puede provocar que en época de invierno la tubería no tenga la suficiente capacidad para transportar las aguas de lluvia. Dado lo anterior se procederá a informar de esta condición al Municipio de Moravia mediante el oficio DRyT-OMSR-2024-00088.
II.Dentro del Parque Los Robles. El personal del AyA realizó una valoración del funcionamiento de la red de alcantarillado sanitario dentro del Parque Los Robles, y no se observó ningún indicio que demuestre que la red de alcantarillado haya tenido un problema reciente en su funcionamiento. En este punto la Quebrada Rivera se encuentra a una distancia considerable, además de estar entubada, por lo que se considera que en este lugar no ha presentado alguna condición que conlleve que las aguas residuales descarguen a la Quebrada.
III.Los Colegios Norte que en las inmediaciones del Parque ubicado entre Dirección09 y Dirección13. En este punto se ha identificado que una tubería principal del AyA fue desviada (Colector Rivera), en apariencia como parte de los trabajos del Proyecto de Mejoramiento Ambiental, a través de la Unidad Ejecutora Programa de Agua Potable y Saneamiento (PAPS). Al realizar este desvío, se dejó una red terciaria sanitaria conectada a la tubería original Colector Rivera cuando se debió dejar conectada a la Nueva Tubería (Desvío). Es condición hace que las aguas residuales se estanquen y generen malos olores. Por lo observado en el campo en el punto A (ver imagen), las aguas se almacenan en un pozo de registro, el cual se va llenando hasta alcanzar un punto donde vierten a la nueva tubería, durante este proceso las aguas se tornan sépticas y generan malos olores. Se requiere mencionar que en el momento de visita no se observaron que las aguas residuales estuvieran descargando a la Quebrada Rivera. Sin embargo se observó un cambio significativo en el color del agua, pasando de una transparente natural de agua de río, a un color negro propio de una agua séptica. En vista de lo anterior, mediante memorando DRyT-OMSR-2024-00087 se procede a informarle a la Unidad Ejecutora PAPS, para que procedan a corregir esta condición en forma inmediata.
IV.El Parque de Los Colegios Norte En este sitio se observó que la red de alcantarillado sanitario funciona con normalidad no se identificaron anomalías en el funcionamiento de esta. Sin embargó, dada la condición mencionada en el punto III, la quebrada se muestra con un flujo de aguas negras. Adicionalmente, se observó que varias propiedades que colindan con el Parque aparentemente descargan sus aguas residuales a la quebrada. Dado lo anterior, mediante oficio DRyT-OMSR-2024-00089 se procede a informar de esta condición al Ministerio de Salud para que proceda a realizar las investigaciones correspondientes. Por último, se requiere mencionar que en este sitio no se observó escombros en la quebrada.
V.Dirección10, ubicado en la Dirección14, detrás de AutoPits En este sitio, la red de alcantarillado sanitario funciona con normalidad, no se detectaron anomalías en el funcionamiento de esta. En lo que respecta a la Quebrada, no se observan descargas que provenga de la red sanitaria administrada por el AyA, sin embargo, las condiciones del flujo se mantienen tal como se observaron en el Punto III. No se observaron condiciones en el caudal que puedan llegar a afectar las propiedades, pero esto es una condición propia de la época seca.
4. Labores realizadas por la Dirección de Recolección y Tratamiento GSGAM. Se considera importante mencionar que la Dirección de Recolección y Tratamiento GSGAM, no ha realizado, planificado o coordinado, el desarrollo de obras de inversión en este sector de Moravia, que vengan a generar problemas de malos olores o provoquen contaminación a la Quebrada Rivera. Como parte de las labores de investigación para la conformación del presente informe se identificó un punto donde se modificó el funcionamiento de la red de alcantarillado sanitario. Se procede a solicitarle a la Unidad Ejecutora del Proyecto PAPS, que corrija la condición encontrada en el Punto III, se le solicita a la Municipalidad valorar la condición de la Quebrada en el Punto I y se le informa al Ministerio de Salud de las descargas encontradas en el Punto IV.
5. Conclusiones 1. A razón de la información aportada por el recurrente, se identificaron 5 puntos donde se denuncia una problemática en el funcionamiento de las aguas residuales. 2. Se procedió a realizar visitas a los sitios identificados encontrado a que en ninguno de estos se haya encontrado que las aguas residuales estén vertiendo a la Quebrada Rivera. Cabe mencionar que esta condición pudo haber ocurrido en el pasado, pero en el momento de la visita no se observó. 3. En uno de estos puntos se identificó un defecto en el funcionamiento de la red de alcantarillado sanitario, por lo que se procedió a solicitarle a la Unidad Ejecutora PAPS la intervención inmediata. 4. No se identificaron escombros en la Quebrada o caudales peligrosos que lleguen a afectar las propiedades. Por lo contrario, el bajo nivel del flujo de la Quebrada genera que las aguas sépticas se estanquen a partir del Punto III. Cabe mencionar que esta condición en el caudal es propia de la época seca (…)”.
Adicionalmente, se determinó que, con motivo de lo hallado en dichas diligencias, el día 19 de febrero de 2024, las autoridades del ICAA giraron una serie de oficios a otras instituciones, en aras de atender la situación presentada. Así, consta que por oficio No. DRyT-OMSR-2024-00087 de 19 de febrero de 2024, autoridades del ICAA comunicaron a la Unidad Ejecutora Programa de Agua Potable y Saneamiento (PAPS) de ese mismo instituto lo siguiente:
“(…) Como parte de las inspecciones realizadas para la conformación del informe solicitado por la Dirección Jurídica a razón de la presentación del Recurso de Amparo – Expediente 24-002429-0007-CO, se encontró una anomalía en el funcionamiento de la red terciaria la cual en apariencia es provocada por las obras realizadas para el Desvío del Colector Rivera, en las cercanías de las Dirección16 (…) Al realizar este desvío, se dejó una red terciaria sanitaria conectada a la tubería original Colector Rivera cuando se debió dejar conectada a la Nueva Tubería (Desvío). Es condición hace que las aguas residuales se estanquen y generen malos olores. Por lo observado en el campo en el punto A (ver imagen), las aguas se almacenan en un pozo de registro, el cual se va llenando hasta alcanzar un punto donde vierten a la nueva tubería, durante este proceso las aguas se tornan sépticas y generan malos olores (…) Dado lo anterior, y a fin de salvaguardar la salud pública y un ambiente ecológicamente equilibrado, se solicita proceder a gestionar las acciones correspondientes a fin de resolver esta problemática, de tal forma que las aguas dejen de acumularse y fluyan en forma correcta (…)”.
Mediante oficio No. DRyT-OMSR-2024-00088 de 19 de febrero de 2024, las autoridades del ICAA informaron y solicitaron a la Municipalidad de Moravia lo siguiente:
“(…) Como parte de las inspecciones realizadas para la conformación del informe solicitado por la Dirección Jurídica a razón de la presentación del Recurso de Amparo – Expediente 24-002429-0007-CO, se encontró una anomalía en el entubamiento de la Quebrada Rivera, al costado Este del Parque Los Robles de Moravia. (…) En este sitio se ha identificado una reducción en la sección de la Quebrada la cual puede ocasionar que la tubería no tenga capacidad para trasportar las aguas en época de invierno (…) Dado lo anterior, se solicitar valorar esta condición y realizar las labores que correspondan (…)”.
Y, por oficio No. DRyT-OMSR-2024-00089 de 19 de febrero de 2024, autoridades del ICAA informaron al Director del Área de Salud de Moravia, que, como parte de las inspecciones realizadas con motivo de este amparo, se encontraron varias viviendas que colindan con el Parque Los Colegios Norte que descargan las aguas residuales a la Quebrada Rivera. Lo anterior, a efecto que se giraran las acciones pertinentes a fin de solventar dicha situación.
De otra parte, se determinó que, con motivo del amparo, el día 20 de febrero de 2024, las autoridades del Área Rectora de Salud de Moravia realizaron inspección en el sector de Colegios Norte de Moravia. Producto de esa inspección se determinó lo siguiente:
“(…) En el sitio se conversa con funcionarios del AyA que realizaban inspección en el sitio. Se realiza un recorrido conjunto por el paso de la nueva tubería de aguas negras instalado por el AyA quienes nos indican que anteriormente existía un “by pas” en funcionamiento el cual se deshabilitó al entrar en acción la nueva tubería en el sitio, no se perciben malos olores y en la tubería de “alivio” no hay salida de aguas negras a la quebrada. Se logra constatar que viviendas se ubican en el área de protección de la quebrada por lo que se traslada al MINAET (…)”.
Además, en oficio No. MS-DRRSCS-DARSM-068-2024 de 21 de febrero de 2024, suscrito por el Director del Área Rectora de Salud de Moravia, se consignó lo siguiente: Que según inspección realizada el 20 de febrero de 2024, no se lograron evidenciar cambios en la dirección del cauce de la quebrada Chiquita o Rivera, ni presencia de escombros. Que en gran parte del cauce entre el Parque del Norte y Dirección10, no se perciben malos olores ni moscas ni roedores. Que durante el recorrido funcionarios del ICAA explicaron que, para realizar mejores en el acueducto sanitario, fue necesario habilitar descargas a la quebrada, las cuales se interrumpieron porque los trabajos finalizaron. Que el tubo por donde se realizaron las descargas de aguas a la quebrada permanecía seco y no presentaba salida de agua a la quebrada Analizado todo lo anterior, este Tribunal Constitucional estima que este extremo del recurso debe ser acogido.
Para ello, es importante señalar primeramente que el derecho a un ambiente sano y ecológicamente equilibrado, debe ser compatibilizado con el principio del desarrollo humano sostenible y con el principio precautorio en materia ambiental, de donde resulta la necesidad de implementar medidas de mitigación ante situaciones riesgosas para el ambiente, pero que sean necesarias para la finalidad del desarrollo y seguridad humanas.
En el caso particular, se acreditó que el actuar inicial de las autoridades del ICAA resultó apegado a esa compatibilización en la medida que, ante el riesgo que claramente implicaba el desfogue temporal de aguas negras sobre la quebrada, implementó una serie de medidas de contención o de mitigación paralelas a la ejecución de tales acciones con el propósito de contener la contaminación y los inconvenientes que claramente se produjeron ante una situación de este tipo (lavados de quebrada con agua limpia a presión, aplicación de microorganismos biorremediadores, etc.).
No obstante, debe tomarse en cuenta que en este asunto se acreditó también que dichas actuaciones no fueron suficientes, pues según inspecciones realizadas por las autoridades del ICAA los días 17 y 18 de febrero del año en curso (con motivo de la interposición de este amparo), se determinó aún la presencia y el discurrir irregular de aguas negras en la zona de interés.
En concreto, se acreditó que en los Colegios Norte (inmediaciones del Parque) “(…) se dejó una red terciaria sanitaria conectada a la tubería original Colector Rivera cuando se debió dejar conectada a la Nueva Tubería (Desvío) (…)”, lo cual, según se afirmó “(…) hace que las aguas residuales se estanquen y generen malos olores (…)”. Además, en dicho sitio se verificó “(…) un cambio significativo en el color del agua, pasando de una transparente natural de agua de río, a un color negro propio de una agua séptica (…)”, por lo que, esta situación se puso en conocimiento de la Unidad Ejecutora de Agua Potable y Saneamiento (PAPS) del ICAA para su corrección.
También, se determinó que en el Parque Los Colegios Norte, dada la condición supra señalada, la quebrada se mostraba con flujo de aguas negras. Igualmente, se logró constatar que “(…) varias propiedades que colindan con el Parque aparentemente descargan sus aguas residuales a la quebrada (…)”, por lo que, en consecuencia, se remitió oficio al Ministerio de Salud para que realizara las investigaciones que se consideraran pertinentes.
Igualmente, se verificó que en el Dirección10 “(…) las condiciones de flujo se mantienen tal como se observaron en el punto III (…)”, es decir, con la presencia de aguas negras.
En esencia, se ha demostrado, entonces, que, en algunos sectores del cantón de Moravia (aun cuando ya finalizaron las referidas descargas a la quebrada), persiste, a la fecha, un problema causado por el discurrir y estancamiento de aguas negras, el cual, a su vez, tiene dos fuentes de origen: las mencionadas labores realizadas por el ICAA y la conducta de algunos vecinos que descargan sus aguas residuales a la quebrada. Situación anterior que, sin duda algunas, se convierte en un claro foco de contaminación y afecta la salud de los vecinos.
Además, no puede perderse de vista que, producto de esa misma inspección realizada por el ICAA, se logró determinar que la quebrada (concretamente a la altura de Dirección06), tiene un estrangulamiento que puede provocar en invierno que la tubería no tenga suficiente capacidad para transportar aguas de lluvia; situación que, también, podría afectar a los vecinos de esa zona en particular. En atención a lo anterior, como se demostró, las autoridades del ICAA remitieron oficio a la Municipalidad de Moravia a efecto que valoraran esa condición y se realizaron las obras que se estimaran pertinentes.
De forma concomitante, resulta menester deparar en un aspecto adicional y es que, también con motivo de la interposición de este amparo, las autoridades del Área de Salud de Moravia, el día 20 de febrero de 2024, realizaron una inspección en las zonas de interés, determinando, entre otros aspectos, que “en gran parte” del cauce entre el Parque del Norte y Dirección10, no se perciben malos olores ni moscas ni roedores, lo cual conlleva claramente a concluir que, entonces, en algunos otros sectores, sí existe la presencia de tales aspectos contaminantes.
Dicho lo anterior, es evidente que aun cuando el alegato sobre la falta de respuesta a la denuncia planteada sobre este tema haya sido planteado de forma prematura ante la Sala, esto se vuelve irrelevante, precisamente porque las autoridades recurridas eran conocedores de la actividad riesgosa que se estaba ejecutando y, pese a ello, tal y como se acreditó, no adoptó de manera oportuna y eficiente, todas las medidas y verificaciones de seguimiento que resultaban necesarias para hacerle frente a la mencionada contaminación producida. El problema alegado por el accionante se mantiene y consta, entonces, que no fue sino por la interposición de este asunto, que las autoridades recurridas, especialmente las del ICAA, intervinieron y giraron instrucciones a otras dependencias internas (Unidad Ejecutora PAPS) así como a otras instancias públicas: Ministerio de Salud y Municipalidad de Moravia, para su atención y pronta resolución.
* De este modo, al tenerse por quebrantado, en perjuicio del recurrente y del resto de vecinos del cantón de Moravia, el derecho constitucional a disfrutar de un ambiente sano y ecológicamente equilibrado estatuido en el ordinal 50 de la Constitución Política, así como su derecho fundamental a la salud, consagrado en el numeral 21 de ese mismo cuerpo normativo, lo que corresponde es acoger este proceso de amparo, en cuanto a estos puntos, con las consecuencias que se dirán en la parte dispositiva de la presente sentencia.
El recurrente también aduce que personal de la Municipalidad de Moravia, durante la ejecución de las obras llamadas “Remodelación Integral y Embellecimiento del Parque de la Urbanización Colegios Norte”, arrojó escombros y tierra sobre el mismo cauce, lo cual generó su desvío y produjo que, en ciertas partes, el agua se estanque reteniendo aguas negras. Sin embargo, acusa que dicha municipalidad hizo caso omiso también a esa problemática. Asimismo, aduce que la quebrada ha consumido las áreas de servidumbre y retiros, poniendo en riesgo los muros y las viviendas.
Revisados los autos, esta Sala no considera que exista mérito para acoger este extremo del recurso. Lo anterior, en primer término, dado que, como se ha dicho, la falta de respuesta a la denuncia planteada sobre el particular, fue alegada ante esta Sala de forma prematura.
En todo caso, debe tomarse en cuenta que el Alcalde de Moravia ha informado a esta jurisdicción, bajo la solemnidad de juramento –con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional–, que “(…) la Municipalidad ha limpiado los escombros en la quebrada a la cual hace referencia (…)”. Además, explicó y expuso que “(…) el efecto de erosión de las cuencas de los ríos o las quebradas es un efecto natural y éste se liga de manera directa a las velocidades de flujo, el cual en los últimos años se ha visto alterado por el efecto del cambio climático (…)”.
Igualmente, cabe señalar que las autoridades del ICAA, los días 17 y 18 de febrero de 2024, realizaron una inspección en la zona de interés, a saber, en el Dirección01, ocasión en la cual, según se indicó, no se observaron escombros en la quebrada, tal y como se aduce, concluyéndose que “(…) No se identificaron escombros en la Quebrada o caudales peligrosos que lleguen a afectar las propiedades (…)”.
Aunado a ello, resulta menester apuntar que, bajo juramento, el Director del Área Rectora de Salud de Moravia informó a esta Sala que “(…) 3. Mediante inspección realizada por funcionarios del Área Rectora de Salud Moravia, el 20 de febrero de 2024, en seguimiento a lo denunciado, no se logra evidenciar cambios en la dirección del cauce de la quebrada Chiquita o Rivera, ni presencia de escombros tal como indica el denunciante (…)”.
Así las cosas, no es posible identificar una violación a los derechos fundamentales del recurrente y del resto de vecinos de la zona de Moravia, en lo tocante a estos aspectos en particular.
En otro orden de consideraciones, el accionante aduce que las autoridades de la Municipalidad de Moravia no han intervenido ni reparado el muro de contención que colapsó hace dos años y se ubica en el Dirección10, lo cual pone en peligro a los vecinos de ese sector. Manifiesta que la única acción que ha tomado el municipio fue el de limpiar los escombros y clausurar el puente que los vecinos, años atrás, habían denunciado que se encontraba falseado.
Revisados los autos, se tiene por demostrado que, ciertamente, tal y como se aduce, en el sector de Dirección10 de Moravia se socavó el muro de contención existente que da hacia la Quebrada Chiquita, así como un puente vehicular/peatonal, debido, entre otros aspectos, a la invasión de las áreas de protección de la quebrada (por la construcción de viviendas) y la elevada velocidad del flujo pluvial. Asimismo, se tiene por acreditado que, ante dicha situación, desde el año 2022, la Municipalidad de Moravia procedió a realizar varias acciones para dar una adecuada solución al tema del muro y del paso existente en el sector del Barrio El Carmen. Entre estas acciones, consta que se procedió a la clausura del espacio y que, además, se contrató un estudio y propuesta de atención. En cuanto a este último punto, se demostró que en febrero de 2023 la empresa INGEOTEC, de acuerdo con la Contratación Directa No. 2022CD-000218-0003300001, presentó a la Municipalidad de Moravia el informe geotécnico y el diseño para el proyecto llamado “Estudios topográficos, geotécnicos, hidrológicos-hidráulicos y diseño de las obras de protección para la quebrada Chiquita, sector de Dirección10”.
En este informe se consignaron los trabajos u obras de protección que se deben realizar para solventar la situación supra descrita (concretamente en el puente y márgenes), cuyo costo asciende a la suma de 151 millones de colones.
Sin embargo, debe tomarse en cuenta que, pese a las referidas acciones ejecutadas, para el día de interpuesto este amparo, las obras señaladas por la citada empresa para la atención y resolución definitiva de dicha problemática no se habían iniciado ni, tampoco, se había definido una fecha probable para tales efectos. Por el contrario, en su informe, el Alcalde de Moravia se limitó a señalar que, para entonces, se encontraban buscando opciones para la asignación de recursos.
De este modo, se observa que la omisión en atender contundentemente la situación en cuestión hace que, a la fecha, persista el peligro y riesgo al que desde hace meses han estado expuestas todas las personas que transitan por la zona, provocando con ello, sin lugar a dudas, una grave afectación y lesión a sus derechos fundamentales. Además, cabe anotar que aun cuando el agravio sobre la falta de atención a la denuncia formulada en enero de 2024 sobre este punto fue alegada de forma prematura ante esta Sala (tal y como reiteradamente se ha dicho), en este asunto se ha constatado que la municipalidad recurrida tenía conocimiento de la situación de interés muchos meses antes, concretamente, desde al menos el año 2022, por lo que, como también se ha dicho, se encontraba en la obligación, desde entonces, de realizar todas las gestiones pertinentes para darle una efectiva y contundente solución al problema. Como estas últimas acciones no se han hecho, este extremo del recurso debe ser acogido, con las consecuencias que se dirán en la parte dispositiva de la presente sentencia.
En mérito de lo expuesto, se impone acoger parcialmente el recurso planteado.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente, indica que las autoridades del Instituto Costarricense de Acueductos y Alcantarillados, como parte de obras realizadas en el cantón de Moravia, procedieron a desviar aguas servidas o negras hacia la Quebrada Chiquita, produciendo con esto una grave contaminación y afectación a la salud de los vecinos de Dirección10, Dirección06 y de Los Colegios Norte.
Además, aseguraron que las nuevas conexiones hechas por el Instituto Costarricense de Acueductos y Alcantarillados han provocado que, cuando llueve, la alcantarilla que colinda con la Quebrada Chiquita ubicada en Barrio El Carmen, se rebase con aguas negras también. Por otra parte, aseguraron que las autoridades de la Municipalidad de Moravia, durante las obras realizadas en el Parque Los Colegios Norte, arrojaron escombros y tierra en el cauce de la quebrada, lo cual generó su desvío y produjo que, en ciertas partes, el agua se estanque reteniendo aguas negras. Finalmente, se expone que la Municipalidad de Moravia no ha intervenido ni reparado el muro de contención y el puente que colapsaron y se ubican en el Dirección10, lo cual pone en peligro a los vecinos del sector. Lo anterior, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
I.Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar parcialmente con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso para que en el plazo de seis meses, contado a partir de la notificación de esta sentencia, sea resueltos la totalidad de los problemas hallados y señalados por el Instituto Costarricense de Acueductos y Alcantarillados, durante las inspecciones ejecutadas durante los días 17 y 18 de febrero de 2024, en lo medular, a lo concerniente con la contaminación y afectación que sufre el recurrente producto del desvío de aguas servidas o negras hacia la Quebrada Chiquita, la cual según su dicho, pasa justo detrás de su casa.
En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
II.Ahora, si bien el presente recurso también se estimó respecto a los siguientes agravios expuestos por la parte recurrente: que las nuevas conexiones hechas por el ICAA han provocado que cuando llueve la alcantarilla que colinda con la Quebrada Chiquita ubicada en Dirección10 se rebase con aguas negras, y que la Municipalidad de Moravia no ha intervenido ni reparado el muro de contención y el puente que colapsaron que se ubican en el Dirección10, lo cual pone en peligro a los vecinos del sector, lo cierto del caso es que en dichos extremos no se realizó ninguna determinación subjetiva o individualización en concreto. En ese sentido, adviértase que el accionante se refiere expresamente a los vecinos del Dirección10 y del Barrio Sagrado Corazón. En consecuencia, respetuosamente y desde mi perspectiva, no luce válido que a tenor de un argumento genérico de “vecinos del Barrio El Carmen y del Barrio Sagrado Corazón” se conozca en esta sede sobre una inactividad administrativa que más corresponde ser residenciada en la jurisdicción contencioso-administrativa. Ergo, salvo el voto y declaro sin lugar el recurso de amparo respecto a estos agravios.
x.- Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
Se declara parcialmente con lugar el recurso (únicamente en cuanto a la contaminación por aguas negras acreditada y respecto a la falta de reparación del muro y del paso peatonal-vehicular ubicados en Dirección10). En consecuencia, se le ordena a Hugo Guevara Sánchez, en su condición de Director del Área Rectora de Salud de Moravia del Ministerio de Salud, a Roosevelt Alvarado Ramírez, en su condición de Sub Gerente General del Instituto Costarricense de Acueductos y Alcantarillados y a Roberto Zoch Gutiérrez, en su condición de Alcalde de Moravia, o a quienes respectivamente ocupen tales cargos, que coordinen lo necesario entre sí, giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, dentro del plazo máximo de SEIS MESES -contado a partir de la notificación de la presente sentencia-, sea resueltos la totalidad de los problemas hallados y señalados por el Instituto Costarricense de Acueductos y Alcantarillados, durante las inspecciones ejecutadas durante los días 17 y 18 de febrero de 2024.
Asimismo, se le ordena a Roberto Zoch Gutiérrez, o a quien en su lugar ocupe el cargo de Alcalde de Moravia, girar las órdenes pertinentes y llevar a cabo todas las actuaciones necesarias para que, dentro del plazo máximo de DOCE MESES -contado a partir de la notificación de esta sentencia-, se lleven a cabo y finalicen los trabajos que se requieren para atender la situación presentada con el muro y el paso peatonal-vehicular ubicados en el Dirección10 de Moravia. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado, al Instituto Costarricense de Acueductos y Alcantarillados y a la Municipalidad de Moravia al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
En amparo, en cuanto a los alegatos tocantes a los trabajos realizados en el Dirección30 por el municipio recurrido y respecto a la resolución de la denuncia planteada el 11 de enero de 2024, se declara sin lugar. El Magistrado Salazar Alvarado pone nota. La Magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Respecto a los demás extremos, declaro sin lugar el recurso debido a que no se individualizó un afectado en concreto. Notifíquese.- Fernando Castillo V.
