Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty a.m. on March fifteenth, two thousand twenty-four.
Amparo proceeding (recurso de amparo) processed under expediente nro. 24-003710-0007-CO, filed by [Nombre01 001], identity card number [Valor CED05], against the MUNICIPALIDAD DE NANDAYURE Findings of Fact (Resultando):
Noncompliance with the legal framework governing the service, in accordance with the provisions of Ley N°8839, Ley N°5395, Ley 7575, 7554, Executive Decree N° 36093-S, and Reglamento Municipal para la Gestión Integral de Residuos del Cantón de Nandayure. 12. Public-health and environmental problems arising from service disruptions and the possibility of suspension due to the lack of its own resources and suitable collection equipment. 14. Limited progress in updating and extending collection routes, as well as in providing separate collection services, due to constraints affecting the ordinary waste collection service. 15. Unsustainability of the collection system (demand exceeds service supply). 16. Intermittent suspension of the service and indefinite suspension (current situation). 17. Regulatory inconsistency under Article N°07 of Executive Decree N°36093- S concerning municipal responsibilities for the solid-waste collection service, as well as the duties of municipalities as decentralized state entities, which are subject to the principle of legality (principio de legalidad) and, therefore, to the entire body of law (bloque de legalidad) consisting of the written and unwritten rules currently in force.
SPECIFICATIONS: Strain on municipal employees and machinery used for solid-waste collection. The municipality currently has 4 employees working as collectors in the solid-waste collection service. Due to the absence of the specialized compactor truck, these individuals have faced greater potential risks to their health and physical safety, as explained below:
1. Dump trucks, by their nature, are not designed to perform this activity. The workers must exert greater force to lift garbage bags of different weights and sizes to the top of the dump truck, placing themselves at risk of bodily injury from excessive exertion. At times, because of the difficulty of throwing the bags, they do not reach the truck bed and fall back toward the collectors, potentially causing injuries to their heads, faces, and other parts of their bodies. It is important to emphasize that the bags travel at an angle greater than 80% when thrown, increasing the potential risk of injury. To prevent this, at the beginning of collection the dump truck’s hydraulic bed is lowered to reduce the effort required to throw the bags; however, once a certain amount of waste has accumulated, the bed can no longer be lowered. To reduce the workers’ exertion, a backhoe is used on the Carmona-Santa Rita and San Pablo route; it lowers its bucket to load the waste and raises it to deposit the waste into the dump trucks. However, the backhoe is not transported to the coastal route because of the travel involved; therefore, the workers must throw the bags into the truck bed without assistance, thereby risking their physical safety.
2. Because of their organic components, the moisture retained in the garbage bags, and the high temperatures in the locations where the service is currently provided (27 °C to 35 °C), conditions favor the production of leachate (lixiviados). When collectors throw the waste into the dump truck, they are exposed to the leachate accumulated inside the bags, which may spill onto their clothing and bodies, and even onto their faces, when the bags tear, are punctured, or arrive open.
3. Because the dump trucks used on the collection routes do not have a waste-compaction system, the volume exceeds their capacity. The collection workers are therefore required to climb onto the beds of the dump trucks and stand on some of the waste to reduce its volume slightly, rearrange certain bags in the beds, or place tarpaulins over the top of the vehicle. The backhoe is used as the dump truck’s storage capacity is exhausted; however, it cannot be present during every work shift on the coastal-sector route. Consequently, the dump trucks have less storage capacity, making the work more difficult.
Public Health and the Environment: Ordinary solid waste, or “garbage,” is accumulated in the collection truck’s sealed compaction chamber and therefore is not exposed to the environment. During collection using dump trucks or another vehicle not designed for this activity, however, the waste remains exposed to the environment, producing foul odors along the routes, creating the possibility that some bags may fall off and be left behind along the collection route without the collectors noticing, resulting in insufficient collection capacity and public dissatisfaction. Wildlife becomes prevalent in population centers: flies, vultures, and dogs are attracted by the odors from the waste, indicating a deficiency in the collection system. It is therefore important to note that the presence of vultures and flies in the streets and public spaces of downtown Carmona and neighboring communities reflects improper handling, because the system does not allow for prompt and effective management. As a result, waste remains in the streets longer while awaiting collection and transportation, and once collected, it remains exposed on top of the dump trucks. Since collection takes place on Tuesdays and Fridays, vultures (Coragyps atratus) are attracted to and disperse throughout the main streets and buildings, serving as an indicator of the quality of service delivery (see annexes).
Movement of machinery and personnel. During 2023, the service has been provided using 2 dump trucks, 1 pickup truck, and two backhoes on the Carmona, Santa Rita, and San Pablo routes, while only the 2 dump trucks are used on the Beaches route, which includes Playa San Miguel, Playa Costa de Oro, Playa Puerto Coyote, San Francisco, La Y Griega, and other neighboring communities. In view of this, during these 10 months of 2023 there has been a deterioration in service delivery due to the situations cited above, which have worsened with the strain on personnel and the wear and tear on municipal equipment such as the dump trucks. Indeed, for this same reason, collection was carried out with only one dump truck for more than two months of the current year. What could generally be collected in one day with a collection truck takes 3 days to collect using a dump truck, bearing in mind that the nearest sanitary landfill (relleno sanitario) is located in the Cantón de Santa Cruz, approximately 56 km away.
It is important to note that the solid-waste collection service has approximately 1671 ratepayers, with the residential sector accounting for the largest population, as shown in the following table. These 1671 ratepayers correspond to housing units, which could represent an affected population of 6684 people who use this service, based on the national average number of residents per housing unit reported by INEC. The following table shows the current ratepayers of the collection service:
As observed in the preceding table, the taxpayers currently using the service are generating an average of 100.5 tons, and this output has continued to trend upward during this 2023 period. According to these data, service provision is strictly limited by the collection, hauling, and disposal capacity currently available to this Municipality, thereby affecting the quality and capacity of the service.
The following table presents the average monthly and annual output of the service.
During this 2023 period, the service has maintained 49% coverage of the canton, with no possibility of extending it to other communities because demand is exceeding collection and hauling capacity. As mentioned throughout this report, this situation has persisted for approximately 3 years; the longer the lack of adequate equipment for properly operating the routes continues, the greater the repercussions identified above will be. Lastly, this Unit once again emphasizes the enormous need for at least one collection truck in order to provide adequate service to the population of the canton of Nandayure and thereby prevent environmental and public-health situations arising from improper management of municipal solid waste. It should therefore be noted that, despite the efforts made to keep the service operating, under the current circumstances the continuity and quality of the service have become unsustainable.
Precedent: On repeated occasions, the Constitutional Chamber of the Supreme Court of Justice of Costa Rica has stated that both the right to health and the right to a healthy environment are fundamental rights enshrined in Article N° 50 of the Political Constitution. The State, its institutions, and the Municipalities are required to take the necessary measures to protect the environment and prevent levels of pollution that endanger the health of the governed; therefore, by virtue of the combined application of Articles 50 and 169 of the Political Constitution, the Municipalities have a duty to guarantee, defend, and preserve the right to a healthy and ecologically balanced environment, as part of the administration of local interests and services. It is important to bear in mind that, pursuant to subsection c) of section 2 of the Organic Law of the Environment, the State must ensure the rational use of environmental resources in order to protect and improve the quality of life of the inhabitants of the national territory.
It is likewise required to foster economically and environmentally sustainable development (desarrollo sostenible), understood as development that satisfies basic human needs without compromising the options of future generations. Municipalities are therefore required to promote sustainable-development models at the local level. Because the provision of solid-waste collection services is considered a matter directly related to public and environmental health, it cannot be subject to conditions such as those described above, which endanger the well-being of the population and its immediate surroundings by making it impossible to perform collection work efficiently and with the necessary equipment to facilitate and guarantee a quality service in accordance with the principles of legality, precaution, and the prohibition against singular derogation (inderogabilidad singular) from the General Health Law and Regulation N° 36093-S concerning comprehensive solid-waste management (Gestión Integral de Residuos).” He requests that the appeal (recurso) be dismissed.
In the municipal government, “…there is a popularly elected deliberative body (the Council), which has very important powers, and an executive body (Nombre02), also popularly elected, which is vested with the executive function within the Municipal Government. Accordingly, the municipal government is composed of two distinct bodies: the Council and the Mayor. The former is a plural deliberative body in which all the political forces of the community that, under the electoral system established by the Political Constitution and the Electoral Code, succeeded in obtaining a seat on that body are represented. The latter is a single-member executive body whose office requires exclusive dedication. From this perspective, although Nombre02 is not part of the Council, Nombre02 is nonetheless an essential component of the Municipal Government” (C-114-2002 of May 9, 2002). The functions of the bodies that comprise the municipal government are clearly detailed in the Municipal Code.
The Council is responsible, among other matters, for establishing the municipality’s development policies and priorities in accordance with the government program registered by the municipal Nombre02 for the term for which that official was elected; adopting budgets and approving contributions, rates, and fees for municipal services; submitting proposed municipal taxes to the Legislative Assembly; issuing regulations for the provision of municipal services; appointing and removing the auditor or accountant and the Council secretary; and notifying the Supreme Electoral Tribunal of any misconduct warranting the automatic removal of a municipal councilor or municipal Nombre02 from office (Article 13). Nombre02, in turn, is responsible for performing the functions inherent in the position of general administrator and head of the municipal departments, overseeing the organization, operation, coordination, and faithful compliance with municipal decisions, laws, and regulations in general; sanctioning and promulgating the resolutions and decisions approved by the Municipal Council and exercising the right of veto; rendering an account to the residents of the canton through a report on activities presented to the Municipal Council; appointing, promoting, and removing municipal personnel, as well as granting them leave and imposing disciplinary sanctions; and serving as the municipality’s legal representative, among other duties (Article 17 of the Municipal Code).
As the Constitutional Chamber has stated, the Municipal Council and Nombre02 are two distinct bodies whose functions and relationships with one another are defined (Judgment N.° 5445-99 of July 14, 1999). This differentiation of functions has a constitutional basis, insofar as Article 169 of the Fundamental Charter provides that: “The administration of local interests and services in each canton shall be entrusted to the Municipal Government, consisting of a deliberative body composed of popularly elected municipal councilors and an executive official designated by law.” There is, therefore, a clear division of functions between the Council and the Mayor, based on the checks and balances inherent in the democratic system enshrined in the Fundamental Charter. Regarding the Municipal Nombre02, the Office of the Attorney General has already stated that this official is the municipality’s single-member superior authority, “…and no relationship of hierarchical subordination may be said to exist with respect to the members of the Municipal Council….” In this regard, it has been stated: “…it should be recalled that Article 17 of the Municipal Code assigns to the Mayor the status of ‘general administrator and head of the municipal departments,’ and administration is nothing other than the performance of active-administration functions (Administración activa).
It also assigns decision-making functions, such as sanctioning or vetoing municipal decisions and authorizing municipal expenditures. Furthermore, the Municipal Code assigns Nombre02 personnel-related functions, including the authority to appoint, grant leave, and impose disciplinary sanctions. It likewise assigns functions that are clearly executive in nature: implementing municipal decisions and overseeing the development of municipal policy and the proper execution of municipal budgets, among others.” (C-048-2004 of February 2, 2004)…” [1] Based on the foregoing, it is plainly evident that the Mayor-Council relationship is not one of subordination but, rather, one of essential inter-administrative collaboration (colaboración interadministrativa), which is indispensable for fulfilling the purpose assigned to local government by the Political Constitution—the administration of local interests and services.
National case law has ruled to this effect, holding: “…Nombre02 is not hierarchically subordinate to the Council; they are bodies with coordinated but independent powers that must ultimately complement one another to ensure the efficient and expeditious operation of municipal governments. The duty to ensure proper compliance with municipal decisions does not presuppose hierarchical subordination to the Council. It is a task inherent in Nombre02’s managerial and enforcement powers, for the sound organization and operation of local services…” [2] In view of the foregoing, neither the Municipal Council of Nandayure nor its President has the authority or power, for example, to order the person responsible for or in charge of the municipal aqueduct to continuously disinfect the water stored and distributed for human consumption, or to require the environmental manager to initiate the procurement procedure (procedimiento de contratación) for a solid-waste collection truck, because doing so would be contrary to the legal system and would amount to co-administration (coadministración), which is absolutely prohibited; these duties are purely administrative.
Once again, in conclusion, the appellant seeks to attribute responsibility for a matter that neither I, as President, nor the Municipal Council, as a representative body, have the authority or power to resolve; it falls within the exclusive authority of the municipal administration, represented by Nombre02 or by the officials responsible for the municipal aqueduct and environmental-management departments, to resolve the matter and carry out the administrative actions necessary to remedy the problem that has arisen.” The appellant requests that the appeal be dismissed.
Justice Cruz Castro drafts the opinion; and,
Whereas:
The petitioner states that the respondent municipality is responsible for providing water for human consumption to the districts of Carmona and Santa Rita, as well as solid-waste collection services throughout the canton. However, both services are experiencing serious problems that endanger the inhabitants’ public health. Regarding the water, it has not undergone chlorination since December 14, 2023, as reported by Nombre02 through an alert posted on its official social-media accounts. With respect to the waste-collection service, the municipality does not have a collection truck. He alleges that on Friday, February 9, 2024, the waste was not collected and remains accumulated along the canton’s streets and sidewalks. He states that during session 197 of the Concejo, broadcast live on February 6, 2024, while Nombre02 was absent, the president of that body read the health orders served by the Ministerio de Salud on Nombre02 and the municipal president in connection with the two aforementioned problems. He alleges that, to date, the respondent authorities have done nothing to resolve the problems described. He requests the intervention of this Court.
The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been substantiated or because the respondent authority failed to address them, as warned in the initial order:
Regarding the complaint concerning the lack of water disinfection in the canton of Nandayure:
Regarding the garbage-collection service provided by the Municipalidad de Nandayure:
The provisions of the AWARD RECOMMENDATION issued by Ignacio Escobar Bray, Encargado de Proveeduría, are approved. The emergency process for procuring the services of a solid-waste collection truck for the Canton of Nandayure, for a temporary period of 3 to 4 months, is awarded to the individual small or medium-sized enterprise (Pyme persona física) JULIO CÉSAR RODRÍGUEZ VEGA, identification card number CED04, for the amount of 70 thousand colones per ton collected in the districts of Carmona, San Pablo, Bejuco, and Santa Rita. The secretary of the Concejo, Ms. Rebeca Chaves Duarte, or whoever holds that office, is authorized to take all administrative actions in the Sicop system necessary to implement this decision. Institutional procurement officer Mr. Ignacio Escobar Brais is requested to proceed with all administrative actions within the scope of his authority so that the initiation order for this procedure may be issued as soon as possible, with a view to safeguarding public health and the public interest of the Canton.” u) On 23 de febrero del 2024, the ordinary solid-waste collection service resumed in the Cantón de Nandayure, and the collected waste is being transported to the Parque Tecnológico Ambiental de Santa Cruz, as the final disposal site approved by the Ministerio de Salud (see report).
The alleged failure to provide potable water service. With respect to the supply of potable water, the case law of this Chamber has primarily focused on protecting the rights to life and health of natural persons. Those rights entail the ability to demand certain services from the State, within which context it is required to provide certain public services, particularly those essential to maintaining sanitary conditions conducive to preserving people’s lives and health. Thus, ensuring the purity of water for human consumption, as well as continuity of its supply, forms part of the proper and efficient provision of service to the subscriber and, in turn, guarantees the subscriber’s most fundamental rights.
First, in this matter, the petitioner claims that since 14 de diciembre de 2023, the respondent municipality, which is responsible for the human-consumption water service in the cantón de Nandayure, has not carried out the water chlorination process, as reported by Nombre02 through an alert posted on its official social-media accounts. The petitioner states that, as of the date this proceeding was filed, the problem had not been resolved.
The reports submitted to this Chamber by the respondent municipal authorities indeed confirm that, in setiembre del año 2023, the municipal entity was unable to carry out the ordinary water-disinfection measures in the cantón due to problems managing equipment maintenance, purchasing materials, and obtaining other necessary supplies. The respondent Municipalidad notified the public of this situation in mid-diciembre del 2023. Consequently, on 06 de febrero de 2024, the Ministerio de Salud Área de Nandayure issued a health order against the respondent municipality for failing to disinfect the potable water service (see report and evidence). In compliance with the order issued by the Ministerio de Salud, on 15 de febrero del 2024, the same day on which the decision admitting this proceeding was served, the respondent Municipalidad approved: a) the request to initiate an order for the purchase of 4 drums of 12% liquid sodium hypochlorite; and b) the request for a commencement order to procure maintenance and repair services for the aqueduct’s pumping system. It also resumed chlorination using tablets in a dry chamber; and on 23 de febrero del 2024, at 11:40 a.m., the health area ordered the closure of the health order.
The foregoing makes clear that the measures specified by the Ministerio de Salud were taken as a result of this proceeding, after which the Ministry lifted the health order that had been imposed and the water service was restored. The constitutional relief petition (recurso de amparo) must therefore be granted, without a special award of costs or damages, together with an order that the management problems be effectively corrected and the measures necessary to disinfect the water in the specified area be adopted, under the terms stated in the operative portion of this judgment.
The alleged failure to provide garbage collection service. In this matter, the petitioning party claims, first, that the Municipalidad de Nandayure does not have a garbage collection truck or a collection-service contract and has not had either for more than 4 years. They state that on viernes 9 de febrero de 2024, the waste was not collected and is accumulating on the streets and sidewalks of the cantón.
A review of the reports rendered under oath, as well as the evidence submitted, shows that garbage collection service in the Cantón de Nandayure has indeed been suspended on various occasions and that there have been difficulties providing the population with adequate service. According to the Head of the Unidad de Gestión Ambiental de la Municipalidad de Nandayure, there is an urgent need for at least one collection truck to prevent environmental and public-health risks arising from the improper management of municipal solid waste.
The reports submitted to this Chamber by the respondent authorities show that, to address the waste-collection problem, the Ministerio de Salud issued a health order against the respondent Alcaldía de Nandayure due to the suspension of solid-waste collection service. In compliance with that order, at its ordinary sessions of 06 and 13 de febrero del 2024, the Concejo Municipal resolved to request that the Alcaldía Municipal and Gestor Ambiental take the corresponding measures within their respective areas of authority to conduct, as soon as possible, a bidding process (proceso licitatorio) pursuant to the Ley General de Contratación Pública and its Reglamento, and to temporarily procure the services of a solid-waste collection truck meeting the requirements imposed by the Ministerio de Salud regarding the transfer, storage, and transportation of leachate (lixiviados). Accordingly, at ordinary session number 198, held on 13 de febrero de 2024—that is, before service of the decision admitting this constitutional relief petition—the Concejo Municipal resolved to call an extraordinary session for jueves 15 de febrero de 2024 to consider and decide the emergency procedure for the temporary procurement of a solid-waste collection truck.
Based on the foregoing, this Chamber finds that, although the respondent Municipalidad adopted certain measures through the Concejo Municipal intended to comply with the health order, that extraordinary session was called before the respondent council became aware of the service of notice of this constitutional relief petition. It was therefore on 23 de febrero de 2024 that the respondent Municipalidad took the measures necessary to resume ordinary solid-waste collection service in the communities of the Cantón de Nandayure affected by the failure to provide the service. Consequently, the garbage is now being transported to the Parque Tecnológico Ambiental de Santa Cruz, as the final disposal site approved by the Ministerio de Salud. It is also established that, after the Nandayure health area verified that the service had returned to normal, it closed and archived health orders N° MS-DRRSCH-DARSNA-OS-008 2024 and N° MS-DRRSCH-DARSNA-OS-009-2024 because the requirements had been fulfilled.
In this regard, it has been established that, although the respondent municipality describes the various measures it took to manage the garbage collection problem once it was notified that this proceeding had been filed, leading to the lifting and archiving of the health order, the fact remains that there is still no definite solution to the garbage collection problem reported by the residents of Nandayure. As demonstrated, the problem persists because there is not even a collection truck available. In this respect, it should be noted that, in the attached report, the representative of the respondent local government emphasized that the solution to the garbage collection problem adopted in response to the health order issued by the health area is temporary. The competent municipal authorities are therefore reminded of their duty to ensure that waste collection service is provided throughout their territory selectively, accessibly, periodically, and efficiently for all inhabitants, as provided in article 8 of the Ley para la Gestión Integral de Residuos, N° 8839.
IV.ON THE AWARD OF COSTS, DAMAGES, AND LOSSES PURSUANT TO ARTICLE 52 OF THE CONSTITUTIONAL JURISDICTION LAW Upon further consideration, the majority of the Chamber finds that, in the case under examination (sub examine), pursuant to the provisions of the first paragraph of Article 52 of the Constitutional Jurisdiction Law (“If, while the amparo proceeding is pending, an administrative or judicial decision is issued that revokes, halts, or suspends the challenged action, the petition shall be granted solely for purposes of compensation and costs, where appropriate”), the petition should be granted without any specific award of costs, damages, and losses, based on the following considerations. Although the law contains express language requiring the operative part of the judgment to state that the petition is granted when the grievance is resolved while the amparo proceeding is pending, it is equally true that the concluding portion of that same paragraph states that the petition is granted “solely for purposes of compensation and costs, where appropriate.” It should be emphasized that the Law states “where appropriate,” meaning that whether compensation and costs are appropriate depends on the Court’s evaluation, assessment, or balancing.
In cases such as this one, the substance of the protected person’s claim and the conduct of the respondent authority in granting it suggest that the alleged impairments, injuries, or alterations do not directly concern an impact on a constitutional right that is clearly proprietary in nature (as would occur, for example, with an impairment of the right to salary). To dispel any doubt in this regard, it is important to highlight Article 51 of the same Constitutional Jurisdiction Law, which provides that: “every decision granting the petition shall make an award in principle (condenará en abstracto) of compensation for the damages and losses caused and payment of the costs of the petition, and their quantification shall be reserved for enforcement of the judgment,” without providing any possibility of assessing whether compensation and costs are appropriate. The principles of Constitutional Law, Public Law, and General Procedural Law or, where applicable, those of International or Community Law and, additionally, in the specified order, the General Public Administration Law, the Contentious-Administrative Procedural Code, and the other procedural codes are supplementary sources for applying and interpreting the provisions of the Constitutional Jurisdiction Law—cf.
Article 14. For the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa), the legislature established, in Article 197 of the Contentious-Administrative Procedural Code, a provision fully applicable to this case by analogy and consistent with procedural logic in any field. In any event, the affected party in the matter before the Court (sub lite) retains the option, should that party so choose, of bringing a plenary proceeding (proceso de conocimiento) to demonstrate that it has suffered some form of impairment. Based on the foregoing, the majority’s position is that this petition should be decided without an award of costs, damages, and losses.
VI.PARTIAL DISSENTING OPINION OF JUSTICES SALAZAR ALVARADO AND GARITA NAVARRO AND JUSTICE JARA VELASQUEZ, SOLELY REGARDING THE FAILURE TO ORDER THE RESPONDENT PARTY TO PAY COSTS, DAMAGES, AND LOSSES.
Although we agree with the rest of the Chamber that the petition should be granted, we depart from the majority’s position insofar as it exempts the respondent party from being ordered to pay the costs, damages, and losses arising from the violation of the protected party’s fundamental rights.
Article 52 of the Constitutional Jurisdiction Law provides that:
“If, while the amparo proceeding is pending, an administrative or judicial decision is issued that revokes, halts, or suspends the challenged action, the petition shall be granted solely for purposes of compensation and costs, where appropriate.” Article 51 thereof, in turn, provides that:
“...every decision granting the petition shall make an award in principle of compensation for the damages and losses caused and payment of the costs of the petition, and their quantification shall be reserved for enforcement of the judgment.” This latter provision establishes the general system governing compensation and payment of costs, which the majority describes as the “natural or ordinary manner of concluding the proceeding, in which a ruling is made on the merits and the facts that violated fundamental rights are acknowledged....” In the majority’s view, the cited Article 51 governs circumstances in which the Chamber has deemed the grievance proven and, consequently, the need arises for an award of costs, damages, and losses. However, in the view of the undersigned, a systematic interpretation of both provisions leads to the conclusion that both where this Constitutional Court finds a violation of a fundamental right and therefore grants the petition, and where the Administration, on its own initiative, restores the aggrieved person’s enjoyment of fundamental rights after learning of the amparo petition—a circumstance contemplated in the aforementioned Article 52—the necessary and unavoidable consequence, by operation of Articles 50 and 51 of the cited law, is an order requiring the violator to compensate for the damages and losses caused and to pay the costs of the petition.
This rule is nothing more than recognition of the right of the party whose fundamental rights have been violated to effective judicial protection (tutela judicial efectiva) concerning redress for the harmful consequences arising from the acts or omissions of the offending authorities; it also serves as a deterrent to prevent the State from again engaging in the actions that formed the basis for granting the petition, a matter governed by Article 50 of the law regulating this jurisdiction. Thus, whether the Chamber deemed the grievance proven and proceeded to consider the merits, or the violation ceased by decision of the respondent authority itself after it learned that the amparo proceeding was underway, thereby restoring the aggrieved person’s enjoyment of fundamental rights (Article 52), there is always, in either circumstance, an imperative need to order the violator to pay costs, damages, and losses, based on the principles of protecting individual rights and requiring the Administration to assume responsibility for the damages and losses caused by its unconstitutional conduct.
Accordingly, the fact that, by the time the amparo petition is heard and granted, the effects of the challenged act have already ceased under Articles 50 and 52 of the cited law does not preclude an award of costs, damages, and losses, because such a case forms an integral part of the general system of mandatory awards in those respects established by the Constitutional Jurisdiction Law.
Furthermore, it is clear that the aforementioned Article 52 applies only in cases where the Chamber, although it has neither considered nor ruled on the merits of the claim, has found that the protected party’s fundamental rights were violated based on the Administration’s restoration of that party’s enjoyment of those rights; this situation, as the majority of the Chamber states, constitutes an “abnormal termination of the proceeding.” The legislature precisely established and delimited the conditions under which this Chamber may order this form of abnormal conclusion of an amparo proceeding, as well as its scope, namely: 1) the amparo proceeding must be pending, meaning that the Administration must have been duly notified of the decision admitting the amparo petition for processing; and 2) there must be an administrative or judicial decision unequivocally ordering the revocation, cessation, or suspension of the challenged action that violated fundamental rights.
The provision in question does indeed establish an exception to the general system of awarding costs, damages, and losses despite the granting of the petition, by providing that, in the cases governed therein, the petition shall be granted “solely for purposes of compensation and costs, where appropriate.” As an exception, it must be interpreted narrowly; that is, it applies only in the circumstances strictly contemplated by the provision, not only because of the rule that exceptions in law must be interpreted narrowly, but also because the consequences of applying that exception unquestionably entail an impairment of individuals’ fundamental right to obtain effective judicial protection against the damages and losses suffered through the violation of their constitutional rights.
In our view, that exception must be interpreted to mean that, under the general system providing for an automatic award of costs, damages, and losses upon a violation of fundamental rights, such an award is always appropriate, even where the respondent party issues an administrative or judicial decision revoking, halting, or suspending the challenged action, unless it is unequivocally and clearly established that no compensable harm was caused in the particular case. Only and exclusively in such circumstances could the respondent Administration be exempted from paying those amounts. Because, in this case, there is no evidence rebutting the presumption that the protected party sustained economic damages and losses arising from the challenged actions—the specific determination of which does not fall within this jurisdiction—the granting of this petition must necessarily entail an award of costs, damages, and losses, and we so declare.
As an additional reason, it should be noted that the very nature and dynamics of amparo proceedings are not primarily intended to analyze whether damages and losses exist, but rather whether acts or omissions exist that may impair or breach the system of individuals’ fundamental rights. From that standpoint, the analysis conducted by this Court focuses on that determination but does not proceed to assess whether those matters have caused harm within the protected persons’ strictly proprietary sphere. Although the aforementioned provision 52 of the LJC, grammatically construed, establishes that such an award (of damages, losses, and costs) applies where appropriate, we, the undersigned, do not consider that this assessment of appropriateness may, a priori, be automatically excluded in this type of proceeding, insofar as it is in a separate ordinary proceeding that it must be determined whether, within the legal relationship examined in the amparo petition, the acts or omissions attributable to the Administration (or to a private-law entity, where applicable) constituted the proximate cause (causa adecuada) of legally compensable proprietary harm.
By way of reference, Articles 179 through 184 of the Contentious-Administrative Procedural Code, Law No. 8508, define a special proceeding intended to determine the financial effects arising from awards entered in these proceedings. Under Article 179 thereof, the purpose of that proceeding is as follows:
“ARTICLE 179.- The Contentious-Administrative Court shall have jurisdiction over the enforcement of judgments issued by the Constitutional Jurisdiction in habeas corpus and amparo proceedings against public-law entities, solely with respect to the proof, quantification, and payment of monetary compensation.” It is clear that this proceeding is directed toward analysis of the necessary prior ruling issued by this Sala concerning an unliquidated award (condena en abstracto) for those items, since such claims would not be admissible in that type of case when the judgment issued in the amparo proceeding (proceso de amparo) expressly establishes that damages (daños y perjuicios) and/or costs (costas) are not warranted, as well as when there is no express ruling on this particular matter. In other words, the special proceeding before the contentious-administrative courts (sede contencioso administrativa) requires, as a sine qua non, an award or express ruling by this Sala Constitucional.
Accordingly, in our view, under the aforementioned section 52 of the LJC, dispensing with such a monetary award (condena patrimonial) requires proof, in each case, of circumstances on the basis of which it may reasonably be found that no actual or even potential monetary harm arose from or was associated with the facts examined. It is therefore an exception that, as such, requires selective and duly reasoned application on a case-by-case basis. The mere fact that, during the proceeding, the Administration issues a decision or a judicial judgment is issued that reverses, halts, or stays the challenged action does not, per se, rule out the possibility that, before such cessation for reasons attributable or unrelated to the respondent entity, the alleged inaction or challenged interference may have caused damages. However, substantive matters concerning whether the harm actually occurred, its amount, whether it was timely claimed, and so forth are assessments that fall outside the nature of these proceedings and which, pursuant to the aforementioned section 52, properly belong to an unliquidated award that subsequently serves as the basis for analysis in the Jurisdicción Contencioso Administrativa.
The relief sought in these constitutional proceedings does not require proof of damages because, as emphasized, that is not their primary purpose or rationale. Thus, the protected person (persona amparada) is not responsible for claiming or proving damages, since what that person seeks is the protection of their fundamental rights. Whether those administrative actions caused that person harm is a matter that, as a matter of principle and except in exceptional cases, does not form part of the basis for analysis in this type of case. It should be noted that, under the circumstance governed by that provision, the Sala Constitucional does not conduct a substantive analysis of the situation for which protection is sought, given the termination of the amparo or habeas corpus due to the aforementioned supervening circumstance (circunstancia sobrevenida). Ergo, in such cases, by operation of law, no determination is made as to whether an infringement occurred; still less can it be determined whether the facts reported by the petitioner may give rise to circumstances warranting civil compensation.
Accordingly, the dispensation from an award referred to in that provision is exceptional, rather than the rule. Por tanto, in those circumstances, the provision requires an unliquidated award so that its propriety may be examined in a separate plenary proceeding (proceso plenario). Otherwise, if exemption from damages and costs were applied as the rule, it would jeopardize protection of the legal position (situación jurídica) of a person who, despite that supervening response by the respondent party, may have suffered harm to their property interests, contrary to section 45 of the Constitución Política and disregarding the Administration’s potential liability, as imposed by article 9 ejusdem. Furthermore, it must not be overlooked that it was by virtue of an action of this nature that conduct was undertaken to bring an end to actions that, in theory, threatened or infringed the person’s fundamental rights.
In other words, to obtain protection of those rights, the person sought judicial relief, and it was by virtue of that relief that the challenged interference ceased. We emphasize that whether the continued threat or deterioration of that person’s situation, until it ceased for the reasons referred to in the provision under review, caused damages is a matter that, absent proof to the contrary, must be examined in an ordinary proceeding (proceso ordinario), but that, we reiterate, must in no way be denied as a threshold matter merely because the factual circumstance governed by the aforementioned section 52 of the LJC occurred. Therefore, with our customary respect for the majority’s position, we issue our separate opinion and reiterate that granting this appeal must necessarily entail an unliquidated award of costs and damages.
The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced through new technologies, they must retrieve them from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of August 22, 2011, article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, article LXXXI.
Por tanto:
The appeal is granted, without a specific award of costs or damages. Leandro Méndez Castillo, in his capacity as Head of the Environmental Management Unit, Giovanni Jiménez Gómez, in his capacity as Nombre02, and Juan Miguel Alvarado Alvarado, in his capacity as President of the Concejo Municipal, all of the Municipalidad de Municipalidad de Nandayure, or whoever may hold those positions, are ordered, within the scope of their authority and in accordance with the report submitted to this Sala, to take the measures necessary to guarantee and ensure the quality and continuity of water service to the residents of the canton of Nandayure. The respondent authority is warned that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo appeal (recurso de amparo) that they must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. Furthermore, the respondent authorities of the Municipalidad de Nandayure shall take note of what is stated in the final paragraph of Considerando III of this judgment. Justices Salazar Alvarado and Garita Navarro and Justice Jara Velásquez partially dissent and order an award of damages and costs.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del quince de marzo de dos mil veinticuatro .
Recurso de amparo que se tramita en expediente nro. 24-003710-0007-CO, interpuesto por [Nombre01 001], cédula de identidad [Valor CED05], contra la MUNICIPALIDAD DE NANDAYURE
Resultando:
Como se observó en la tabla anterior, los contribuyentes que actualmente hacen uso del servicio están generando en promedio 100.5 toneladas y esta producción mantiene una tendencia de aumento durante este periodo 2023, conforme a estos datos, la prestación del servicio se ve estrictamente limitada a la capacidad de recolección, acarreo y disposición con que esta municipalidad cuenta actualmente, viéndose afectada la calidad y capacidad del servicio.
A continuación, se presenta el siguiente cuadro con los promedios de producción mensuales y anuales del servicio.
Durante este periodo 2023, el servicio mantiene un 49% de cobertura cantonal, sin posibilidad a extenderse a otras comunidades, pues la demanda se encuentra sobrepasando la capacidad de recolección y acarreo. Esta situación como se ha mencionado a lo largo de este informe se ha prolongado por 3 años aproximadamente; conforme continue prolongándose el equipamiento adecuado para la ejecución de las rutas de forma adecuada mayores serán las repercusiones anteriormente definidas. Por último, esta Unidad vuelve a destacar la enorme necesidad de contar con al menos un camión recolector, para poder brindar un adecuado servicio a la población del cantón de Nandayure, así prevenir situaciones en materia ambiental y de salud pública, derivadas de un inadecuado manejo de los residuos sólidos municipales, así, se debe mencionar que tras los esfuerzos realizados para mantener a flote el servicio, mediante las actuales se torna insostenible la continuidad y calidad del servicio.
Precedente: En reiteradas ocasiones la Sala Constitucional de la Corte Suprema de Justicia de Costa Rica ha manifestado que tanto, el derecho a la salud, como a un ambiente sano, constituyen derechos fundamentales consagrados en el artículo N° 50 de la Constitución Política. El Estado, sus instituciones y las Municipalidades se encuentran obligadas a tomar las medidas necesarias para proteger el medio ambiente y evitar grados de contaminación que pongan en peligro la salud de los administrados y por tanto, es un deber de la Municipalidades derivado de la conjugación de los artículos 50 y 169 de la Constitución Política garantizar, defender y preservar el derecho a un ambiente sano y ecológicamente equilibrado, correspondiente a la administración de los intereses y servicios locales. Es importantes tomar en cuenta que de conformidad con el inciso c) del numeral 2 de la Ley Orgánica del Ambiente, el Estado, debe velar por la utilización racional de los elementos ambientales, con el fin de proteger y mejorar la calidad de vida de los habitantes del territorio nacional, asimismo, se encuentra obligado a propiciar un desarrollo económico y ambientalmente sostenible, entendiendo como el desarrollo que satisface las necesidades humanas básicas, sin comprometer las opciones de las generaciones futuras.
De esta forma, las municipalidades están obligadas en promover modelos de desarrollo sostenible a nivel local. Por considerarse un tema directamente relacionado a salud pública y medio-ambiental, la prestación del servicio de recolección de residuos sólidos, no puede estar sujeto a condicionamientos como los expuestos anteriormente, que pone en riesgo el bienestar de la población y de su entorno directo, ante la imposibilidad de ejecutar las labores de recolección de forma eficiente y con los instrumentos necesarios que faciliten y garanticen un servicio de calidad con base en los principios de legalidad, precautorio y inderogabilidad singular de la ley general de salud y reglamento N° 36093-S, en materia de gestión integral de residuos sólidos.” Pide se declare sin lugar el recurso.
Redacta el Magistrado Cruz Castro; y,
Considerando:
El accionante expone que la municipalidad recurrida es la encargada del servicio de agua para consumo humano de los distritos Carmona y Santa Rita, así como también del servicio de recolección de residuos sólidos de todo el cantón. Sin embargo, ambos servicios están presentando problemas graves que ponen en riesgo la salud pública de los habitantes. En cuanto al agua, no se le ha dado el proceso de cloración desde el 14 de diciembre de 2023, lo que fue informado por el Nombre02 mediante comunicado de alerta en sus redes sociales oficiales. En relación con el servicio de recolección de residuos, la municipalidad no cuenta con camión recolector. Acusa que el viernes 9 de febrero de 2024, no se recogieron los residuos y están acumulados por las calles y aceras del cantón. Señala que en sesión 197 del Concejo, transmitida en vivo el 6 de febrero de 2024, con el Nombre02 ausente, el presidente de dicho órgano leyó las órdenes sanitarias notificadas por el Ministerio de Salud, al Nombre02 y al presidente municipal, en relación con los dos problemas citados. Acusa que a la fecha las autoridades recurridas no han hecho nada para dar una solución a los problemas descritos. Pide la intervención de este Tribunal.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
En cuanto al reclamo por la falta de desinfección del agua en el cantón de Nandayure:
Del servicio de recolección de basura prestado por la Municipalidad de Nandayure:
Se aprueba lo indicado en la RECOMENDACIÓN DE ADJUDICACIÓN emitida por Ignacio Escobar Bray, Encargado de Proveeduría. Adjudicar el proceso de urgencia para la contratación del servicio de un camión recolector de residuos sólidos para el Cantón de Nandayure, por un periodo temporal de 3 a 4 meses, a la Pyme persona física JULIO CÉSAR RODRÍGUEZ VEGA con cédula de identidad número CED04, por la suma de 70 mil colones por tonelada recolectada, en los distritos de Carmona, San Pablo, Bejuco y Santa Rita. Se autoriza a la secretaria del Concejo Sra. Rebeca Chaves Duarte o a quien ocupe su cargo, realizar todas las acciones administrativas en el sistema Sicop para cumplir con este acuerdo. Se le solicita al proveedor institucional Sr. Ignacio Escobar Brais que prosiga con todas las acciones administrativas dentro del ámbito de sus facultades para que a la mayor brevedad se dé la orden de inicio de este procedimiento, en procura de salvaguardar la salud pública y el interés público del Cantón.” u) El 23 de febrero del 2024, se reanudó el servicio de recolección de residuos sólidos ordinarios, en el Cantón de Nandayure, de tal forma que los residuos recolectados están siendo trasladados hasta el Parque Tecnológico Ambiental de Santa Cruz, como sitio de disposición final aprobado por el Ministerio de Salud (ver informe).
De la acusada falta de prestación del servicio de agua potable. En materia de suministro de agua potable, la jurisprudencia de esta Sala se ha dirigido fundamentalmente a la protección del derecho a la vida y a la salud de las personas físicas. Esos derechos implican la posibilidad de exigir ciertas prestaciones del Estado, ámbito en el cual se ve obligado a proporcionar algunos servicios públicos, sobre todo los que resultan esenciales para mantener condiciones sanitarias favorables a la preservación de la vida y la salud de las personas. De este modo, garantizar la pureza del líquido para consumo humano, así como la continuidad en el suministro de éste, forman parte de un debido y eficiente servicio al abonado, y a su vez garantiza sus derechos fundamentales más elementales.
En primer lugar, en el presente asunto, el accionante reclama que desde el 14 de diciembre de 2023, la municipalidad recurrida como encargada del servicio de agua para consumo humano del cantón de Nandayure, no ha realizado el proceso de cloración del agua, lo que fue informado por el Nombre02 mediante comunicado de alerta en sus redes sociales oficiales. Señala que a la fecha de interponer este proceso, el problema no ha sido solucionado.
De los informes dados a esta Sala por las autoridades municipales recurridas, efectivamente se confirma que en setiembre del año 2023, el ente municipal no pudo realizar las acciones ordinarias de desinfección del agua en el cantón, por problemas de gestión de mantenimiento del equipo, compra de materiales y otros insumos necesarios. Lo anterior fue advertido a la población por parte de la Municipalidad recurrida a mediados de diciembre del 2023. Como consecuencia de lo anterior, el 06 de febrero de 2024, el Ministerio de Salud Área de Nandayure impuso a la municipalidad recurrida la orden sanitaria por la falta de desinfección del servicio de agua potable a la (ver informe y prueba). En cumplimiento a lo ordenado por el Ministerio de Salud, el 15 de febrero del 2024, mismo día que se notifica la resolución que da curso a este proceso, la Municipalidad recurrida aprobó: a) la solicitud para iniciar una orden para la compra de 4 estañones de hipoclorito de sodio liquido al 12%, b) la solicitud de orden de inicio para la contratación del servicio de mantenimiento y reparación del sistema de bombeo del acueducto Asimismo, retomó el clorado con pastilla en cámara seca; y el 23 de febrero del 2024, al ser las 11:40 a.m. el área de salud ordenó el cierre de la orden sanitaria.
De lo expuesto, queda claro que es con ocasión de este proceso, que se tomaron las medidas indicadas por el Ministerio de Salud, que levantó la orden sanitaria impuesta y se restituyó el servicio de agua. Por ello, procede acoger el recurso, sin especial condenatoria en costas, daños y perjuicios, con la orden de que, efectivamente, se corrijan los problemas de gestión y se tomen las medidas necesarias para la desinfección del agua en la zona indicada, en los términos que se indica en la parte dispositiva de esta sentencia.
De la acusada falta de prestación del servicio de recolección de basura. En el presente asunto la parte recurrente reclama por un lado que la Municipalidad de Nandayure no cuenta con un camión recolector de basura, ni con un contrato de servicio de recolección desde hace más de 4 años. Señalan que el viernes 9 de febrero de 2024, no se recogieron los residuos y están acumulados por las calles y aceras del cantón.
Luego de revisados los informes rendidos bajo la solemnidad de juramento, así como la prueba aportada, se desprende que efectivamente en el Cantón de Nandayure se han presentado suspensiones en el servicio de recolección de basura y dificultades para brindar un adecuado servicio a la población. Según el Jefe de la Unidad de Gestión Ambiental de la Municipalidad de Nandayure existe una enorme necesidad de contar con al menos un camión recolector, que permita evitar situaciones de riesgo en materia ambiental y de salud pública, derivadas de un inadecuado manejo de los residuos sólidos municipales.
De los informes presentados a esta Sala por parte de las autoridades recurridas, se tiene que, para atender el problema de recolección de desechos, el Ministerio de Salud impuso a la Alcaldía de Nandayure recurrida, una orden sanitaria por la suspensión del servicio de recolección de residuos sólidos. Es en cumplimiento de esa orden que el Concejo Municipal, en sesión ordinaria de los días 06 y 13 de febrero del 2024, acordó pedir a la Alcaldía Municipal y Gestor Ambiental que procedan a tomar las medidas correspondientes, dentro del ámbito de su competencia para realizar a la mayor brevedad posible, un proceso licitatorio, conforme a la Ley General de Contratación Pública y su Reglamento, y contratar temporalmente los servicios de un camión recolector de desechos sólidos, que reúna los requisitos exigidos por el Ministerio de Salud en cuanto al traslado, almacenaje y transporte de lixiviados. En ese sentido, en la sesión ordinaria número 198 celebrada el día 13 de febrero de 2024, -es decir anterior a la notificación de la resolución que dio curso al presente recurso de amparo- el Concejo Municipal acordó convocar a una sesión extraordinaria para el día jueves 15 de febrero de 2024, para conocer y resolver el proceso de urgencia para la contratación temporal de un camión recolector de residuos sólidos.
De lo expuesto, esta Sala considera que, si bien la Municipalidad recurrida ha adoptado algunos actos encaminados para dar cumplimiento a la orden sanitaria por parte del Concejo Municipal, dicha sesión extraordinaria fue convocada anterior a que el concejo recurrido tuviese conocimiento de la notificación del presente recurso de amparo, por lo que en fecha 23 de febrero de 2024, que la Municipalidad recurrida realiza los actos necesarios para reanudar el servicio de recolección de residuos sólidos ordinarios, en las comunidades afectadas por la falta de prestación del servicio en el Cantón de Nandayure. De tal forma que ya la basura está siendo trasladada hasta el Parque Tecnológico Ambiental de Santa Cruz, como sitio de disposición final aprobado por el Ministerio de Salud. Se tiene además que, al ser constatada por el área de salud de Nandayure la normalización del servicio, esta procedió a realizar el cierre y archivo de las ordenes sanitarias N° MS-DRRSCH-DARSNA-OS-008 2024 y N° MS-DRRSCH-DARSNA-OS-009-2024, pues se cumplió con lo solicitado.
Al respecto, se acredita que si bien la municipalidad recurrida describe las diferentes gestiones que ha realizado sobre el manejo del problema de recolección de basura, una vez comunicado de la interposición de este proceso, y por ello se levantó y archivó la orden sanitaria, impera el hecho que no existe todavía una solución con certeza del problema de recolección de basura denunciado por los vecinos de Nandayure, el cual conforme quedó demostrado todavía persiste, pues no se cuenta siquiera con un camión recolector. En ese sentido, adviértase que en el informe adjunto, el personero del gobierno local recurrido subrayó que la solución al problema de recolección de basura, en atención a la orden sanitaria emitida por el área de salud, es temporal. Por ello, se advierte a las autoridades municipales competentes su deber de garantizar que en su territorio se provea del servicio de recolección de residuos en forma selectiva, accesible, periódica y eficiente para todos los habitantes, según lo dispuesto en el artículo 8 de la Ley para la Gestión Integral de Residuos, N° 8839.
IV.SOBRE LA CONDENATORIA EN COSTAS, DAÑOS Y PERJUICIOS DE CONFORMIDAD CON EL ARTÍCULO 52 DE LA LEY DE LA JURISDICCIÓN CONSTITUCIONAL Bajo una mejor ponderación, la mayoría de la Sala considera que, en el sub examine, de conformidad con lo dispuesto en el párrafo 1° del artículo 52 de la Ley de la Jurisdicción Constitucional (“Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes”), la estimatoria debe serlo sin especial condenatoria en costas, daños y perjuicios, con base en las siguientes consideraciones. Si bien hay un texto expreso en la ley que obliga a que la parte dispositiva del fallo indique que se declara con lugar el recurso, cuando estando en curso del amparo se resuelva el agravio, no menos cierto es que ese mismo párrafo in fine refiere que la estimatoria se dicta “únicamente para efectos de indemnización y de costas, si fueren procedentes”.
Se subraya que la Ley indica “si fueren procedentes”, lo cual significa que la procedencia o improcedencia de la indemnización y costas depende de una valoración, apreciación o ponderación del Tribunal. En casos como este, el contenido de la pretensión de la persona amparada y la conducta de la autoridad recurrida de reconocer aquella, sugieren que los menoscabos, lesiones o alteraciones alegados no están referidos de modo directo a una repercusión en un derecho constitucional de evidente naturaleza patrimonial (como sí ocurriría, por ejemplo, con una afectación al derecho al salario). Para disipar cualquier duda al respecto, es importante destacar lo dispuesto en el artículo 51 de la misma Ley de la Jurisdicción Constitucional, cuando dispone que: “toda resolución que acoja el recurso condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas del recurso, y se reservará su liquidación para la ejecución de sentencia”, donde no se prevé la posibilidad de valorar si procede o no lo concerniente a indemnización y costas.
Los principios del Derecho Constitucional, los del Público y Procesal General o, en su caso, los del Derecho Internacional o Comunitario y, además, por su orden, la Ley General de la Administración Pública y el Código Procesal Contencioso Administrativo y los demás códigos procesales, son fuente supletoria para la aplicación e interpretación de las normas de la Ley de la Jurisdicción Constitucional -cfr. artículo 14-. Para la jurisdicción contencioso-administrativa, el legislador estableció un precepto plenamente aplicable al caso por analogía, en el artículo 197 del Código Procesal Contencioso Administrativo, que responde a la lógica procesal en cualquier materia. En todo caso, la parte afectada del sub lite preserva la posibilidad de acudir, si a bien lo tiene, a un proceso de conocimiento a fin de demostrar que ha sufrido algún tipo de menoscabo. Con base en lo anterior, es criterio de mayoría resolver este recurso sin condenatoria en costas, daños y perjuicios.
VI.VOTO SALVADO PARCIAL DE LOS MAGISTRADOS SALAZAR ALVARADO, y GARITA NAVARRO Y LA MAGISTRADA JARA VELASQUEZ ÚNICAMENTE EN RELACIÓN CON LA NO CONDENATORIA EN COSTAS, DAÑOS Y PERJUICIOS A LA PARTE RECURRIDA.
Si bien coincidimos con el resto de la Sala en declarar con lugar el recurso, nos separamos del criterio de mayoría en cuanto exime de condenar a la parte recurrida al pago de las costas, daños y perjuicios derivados de la lesión producida a los derechos fundamentales de la parte tutelada.
La Ley de la Jurisdicción Constitucional, en el artículo 52, dispone que:
“Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes”.
Por otra parte, en el artículo 51 ibídem, se establece que:
“...toda resolución que acoja el recurso condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas del recurso, y se reservará su liquidación para la ejecución de sentencia”.
Esta última norma establece el sistema general que regula lo relativo al tema de la indemnización y el pago de las costas, y que la mayoría denomina “forma natural o normal de terminación del proceso, donde hay pronunciamiento sobre el fondo del asunto y reconocimiento de los hechos que han vulnerado los derechos fundamentales…”.
En criterio de la mayoría, el artículo 51, de cita, regula los supuestos en los que la Sala ha tenido por comprobado el agravio; y, como consecuencia, surge la necesidad de una condenatoria en costas, daños y perjuicios. Sin embargo, a juicio de los suscritos, de la interpretación sistemática de ambas normas, se concluye que, tanto en los casos en que este Tribunal Constitucional constate una lesión a algún derecho fundamental; y, por ende, declare con lugar el recurso, como en aquellos en los que la Administración, por decisión propia, restituya a la persona agraviada en el goce de sus derechos fundamentales, una vez que tenga conocimiento del amparo -supuesto contemplado en el artículo 52, referido-, por imperio de los artículos 50 y 51, de la ley citada, la consecuencia necesaria e ineludible es la condenatoria al infractor a la indemnización de los daños y perjuicios causados y del pago de las costas del recurso.
Esta regla no es más que el reconocimiento, a la parte que ha sufrido una vulneración en sus derechos fundamentales, del derecho a una tutela judicial efectiva en torno a la reparación de las consecuencias dañosas derivadas de las actuaciones u omisiones de las autoridades infractoras; y, como medio disuasivo, a fin de que el Estado no incurra nuevamente en las acciones que dieron base a la estimatoria del recurso, tema regulado en el artículo 50, de la ley que rige esta jurisdicción. De modo, que ya sea que la Sala haya tenido por comprobado el agravio y haya entrado a conocer el fondo del asunto, o que la violación haya cesado por decisión de la propia autoridad recurrida, una vez que tuvo conocimiento de la tramitación del amparo, con restitución en el goce de los derechos fundamentales a favor del agraviado (artículo 52), siempre, en cualesquiera de esos supuestos, surge la imperiosa necesidad de una condenatoria en costas, daños y perjuicios al infractor, cuyo fundamento se encuentra en los principios de tutela de los derechos de las personas y en el de que la Administración debe hacerse responsable por los daños y perjuicios que ocasione con su actuar inconstitucional.
Así, el hecho de que al momento de conocerse y resolverse con lugar el amparo, los efectos del acto impugnado ya hubieren cesado, en los términos de lo dispuesto en los artículos 50 y 52, de la ley de cita, no enerva la procedencia de la condenatoria en costas, daños y perjuicios, pues tal caso forma parte integral del sistema general de condenatoria necesaria en esos extremos, que contiene la Ley de la Jurisdicción Constitucional.
Por otra parte, es claro que el artículo 52, mencionado, se aplica únicamente en los casos en que la Sala, aun cuando no ha conocido, ni se ha pronunciado sobre el fondo del reclamo, ha constatado la vulneración que en sus derechos fundamentales ha sufrido la parte amparada, en virtud de la restitución, que, en el goce de esos derechos, ha acordado a su favor la Administración; situación que, tal y como la afirma la mayoría de la Sala, implica una "terminación anormal del proceso”.
El legislador estableció y delimitó, de forma precisa, las condiciones en las cuales esta Sala puede decretar esa forma de conclusión anormal del proceso de amparo, así como sus alcances, a saber: 1) que el amparo esté en curso, es decir, que la Administración haya sido debidamente notificada de la resolución que dio curso al amparo; y, 2) que exista una resolución administrativa o judicial que disponga, de forma indubitable, la revocación, detención o suspensión de la actuación impugnada violatoria de derechos fundamentales. Ciertamente, la norma en cuestión contempla una excepción al sistema general de condenatoria en costas, daños y perjuicios, no obstante la estimatoria del recurso, al disponer que, en los casos allí regulados, se declarará con lugar el recurso “únicamente para efectos de indemnización y de costas, si fueren procedentes”. Como excepción que es, debe ser interpretada restrictivamente; es decir, que solo procede en los supuestos estrictamente contemplados en la norma, no solo por la regla de que las excepciones en derecho deben interpretarse de forma restrictiva, sino también porque las consecuencias de aplicar tal excepción implican, sin lugar a dudas, un menoscabo en el derecho fundamental de las personas a obtener una efectiva tutela judicial frente a los daños y perjuicios sufridos con la lesión a sus derechos constitucionales.
En nuestro criterio, tal excepción se debe interpretar en el sentido de que, de conformidad con el sistema general de condenatoria automática en costas, daños y perjuicios ante una violación a derechos fundamentales, esa condenatoria es siempre procedente, aún en el caso de que la parte recurrida dicte una resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, a menos que conste de manera indubitable y clara que en el caso concreto no se causó perjuicio alguno capaz de ser indemnizado. Solo y únicamente en tales supuestos podría eximirse a la Administración recurrida del pago de dichos extremos. Como en este caso, no existe elemento alguno que desvirtúe la presunción del surgimiento, para la parte amparada, de daños y perjuicios económicos derivados de las actuaciones impugnadas -cuya determinación concreta no le corresponde a esta jurisdicción-, la estimatoria de este recurso debe implicar, necesariamente, la condenatoria en costas, daños y perjuicios, y así lo declaramos.
Como razón adicional, cabe destacar que la dinámica y esencia misma de los procesos de amparo, no tiene por objeto primario el análisis de la existencia o no de daños y perjuicios, sino, de la existencia o no de acciones u omisiones que puedan generar o producir un quebranto al régimen de los derechos fundamentales de las personas. Desde esa arista, el análisis que realiza esta sede, se concentra en dicha verificación, empero, no ingresa a la ponderación de si esas cuestiones han generado o no lesiones en el ámbito eminentemente patrimonial de las personas amparadas. Si bien el precitado precepto 52, de la LJC, en su ámbito gramatical, estatuye que dicha condena (en daños, perjuicios y costas) opera, de ser procedente, no estimamos los suscritos que dicho examen de pertinencia pueda, a priori, excluirse de manera automática en este tipo de procesos, en la medida en que, es dentro de otro proceso ordinario, que se ha de definir si dentro de la relación jurídica analizada en el recurso de amparo, las conductas u omisiones imputables a la Administración (o sujeto de derecho privado, cuando corresponda), se han constituido como causa adecuada de lesiones de orden patrimonial, que sean jurídicamente indemnizables.
A modo de referencia, los numerales 179 al 184, del Código Procesal Contencioso Administrativo, Ley N° 8508, define un proceso especial que tiene por objeto la definición de los efectos económicos derivados de condenas dictadas en estos procesos. A la luz del canon 179 ejusdem, ese proceso tiene por objeto lo siguiente:
“ARTÍCULO 179.- Corresponde al Juzgado de lo Contencioso-Administrativo, la ejecución de las sentencias dictadas por la Jurisdicción Constitucional, en procesos de hábeas corpus y de amparo contra sujetos de Derecho público, únicamente en lo relativo a la demostración, la liquidación y el cumplimiento de indemnizaciones pecuniarias”.
Es claro que ese proceso se direcciona al análisis del antecedente necesario emitido por esta Sala en cuanto a una condena en abstracto en esos rubros, pues no procedería ese tipo de pretensiones dentro de ese tipo de causas, cuando la sentencia dictada dentro del proceso de amparo, estableciere, de manera expresa, la improcedencia de daños, perjuicios y/o costas, así como cuando no exista pronunciamiento expreso en cuanto a este particular. Es decir, el proceso especial en sede contencioso administrativa, requiere, a modo de requisito sine qua non, de condena o pronunciamiento expreso por parte de esta Sala Constitucional. En ese orden, a nuestro juicio, al tenor del mencionado ordinal 52, de la LJC, la dispensa en esa condena patrimonial precisa de la acreditación, en cada caso, de situaciones a partir de las cuales, es estime, motivadamente, la inexistencia de lesiones patrimoniales, aún potenciales, derivadas o asociadas a los hechos analizados.
Por ende, se trata de una excepción, que, como tal, requiere de aplicación calificada y debidamente fundamentada de manera casuística. La sola circunstancia que, en el curso del trámite, la Administración dicte resolución o se emita sentencia judicial que revoque, detenga o suspenda la actuación impugnada, no descarta, per se, que, de previo a esa cesación por causa propia o ajena al ente accionado, la indolencia acusada o perturbación reprochada, haya llegado a ocasionar daños y perjuicios. Sin embargo, tal cuestión de fondo, en lo relativo a la efectividad de las lesiones, su cuantía, reclamo oportuno, etc., son ponderaciones que escapan a la naturaleza de estos procesos y respecto de la cual, en orden a lo regulado por el mandato 52 aludido, son propias de una condena en abstracto que luego constituye base de análisis en la Jurisdicción Contencioso Administrativa. La tutela que se pretende en estos procesos de orden constitucional no precisa de la demostración de daños y perjuicios, pues, se insiste, no es su objeto o ratio primaria.
Así, no corresponde a la persona amparada el reclamo o demostración de daños, siendo que lo que busca es el resguardo de sus derechos fundamentales. Luego, si esas conductas administrativas le han producido lesiones, es un extremo que, por tesis de principio y salvo casos excepcionales, no forman parte de la base de análisis de este tipo de causas. Nótese que, en el supuesto regulado en ese mandato, la Sala Constitucional no hace un análisis de fondo de la situación a tutelar, dada la terminación del amparo o habeas corpus por la circunstancia sobrevenida ya citada. Ergo, en estos casos, por imperativo legal, no se ingresa a valorar si hay o no infracción, con lo cual, mucho menos puede definirse si a partir de lo denunciado por el requirente, puede haber o no situaciones de posible reparación civil. De esa manera, la dispensa de condena a que alude esa norma, es de orden excepcional, no de principio.
Por tanto, en esos supuestos, la norma impone la condena en abstracto, para que sea dentro de otro proceso plenario, que se analice su procedencia. De otro modo, de aplicarse como regla esa liberación de daños, perjuicios y costas, se estaría poniendo en riesgo la tutela de la situación jurídica de la persona que, pese a esa respuesta sobrevenida de la parte reclamada, pudo haber sufrido lesiones en su esfera patrimonial, en detrimento de lo estatuido por el precepto 45, de la Constitución Política, y desconociendo la potencial responsabilidad de la Administración, tal y como lo impone el artículo 9 ejusdem. Además, no debe dejarse de lado que fue en virtud de una acción de esa índole, que se adoptó una conducta que hace cesar las conductas que, en teoría, amenazan o conculcan los derechos fundamentales de la persona. Es decir, a efectos de obtener el resguardo de esos derechos, la persona optó por la tutela judicial, y fue por esa virtud, que se produce el cese de la perturbación reprochada.
Se insiste, si la permanencia de la amenaza o deterioro de su situación en tanto se hizo cesar por las causas aludidas en la norma bajo examen, generó daños y perjuicios, es un tema que, salvo prueba en contrario, debe ser analizado dentro de un proceso ordinario, pero que, se reitera, en modo alguno, debe negarse, como presupuesto, por la sola concreción del supuesto de hecho regulado en el mencionado ordinal 52, de la LJC. Por ende, con el respeto de siempre en cuanto a la postura de mayoría, externamos nuestro voto y reiteramos que la estimatoria de este recurso debe implicar, necesariamente, la condenatoria en abstracto en costas, daños y perjuicios.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso, sin especial condenatoria en costas, daños y perjuicios. Se ordena a Leandro Méndez Castillo en su calidad de Jefe de la Unidad de Gestión Ambiental, Giovanni Jiménez Gómez, en su condición de Nombre02 y Juan Miguel Alvarado Alvarado, en su condición de Presidente del Concejo Municipal todos de la Municipalidad de Municipalidad de Nandayure o a quienes ocupen tales cargos que, dentro del marco de sus competencias, y según el informe dado a esta Sala, tomen las medidas necesarias para garantizar y asegurar la calidad y continuidad de la prestación del servicio de agua, a los vecinos del cantón de Nandayure. Se advierte a la autoridad recurrida que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Además, tomen nota las autoridades recurridas de la Municipalidad de Nandayure de lo indicado en el último párrafo del considerando III de esta sentencia. Los magistrados Salazar Alvarado, y Garita Navarro y la Magistrada Jara Velásquez salvan parcialmente el voto y disponen la condenatoria en daños perjuicios y costas.
