Document Review Case: 24-002313-0007-CO Decision No. 2024004807 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty a.m. on veintitres de febrero de dos mil veinticuatro.

Petition for amparo (recurso de amparo) being processed under case no. 24-002313- 0007-CO, filed by [Nombre01 001], identity card [Valor CED04], against the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (Sinac) and the MUNICIPALIDAD DE GARABITO.

Findings:

  1. 1By a filing received by the Office of the Clerk of the Chamber on 29 de enero de 2024, the petitioner filed a petition for amparo against the Ministerio de Ambiente y Energía (Minae), Sinac, and the Municipalidad de Garabito. The petitioner states that several years ago they acquired land in an area adjacent to and bordering Laguna de Carrizal, in the Bajamar sector of Garabito de Puntarenas, which is a recognized wetland (humedal) forming part of the Paso Las Lapas biological corridor (corredor biológico). The petitioner explains that, in setiembre y octubre de 2023, certain individuals offered to sell them land adjoining the rear of their property, which is located within the protected public zone (zona pública protegida) of Laguna de Carrizal; however, they declined to participate in the transaction. The petitioner alleges that the protected area (zona protegida) of the lagoon was subsequently encroached upon at a dead-end street terminating at its boundary, where an unauthorized access route was opened and work began to remove both the vegetation layer (capa vegetal) and the flora and fauna; earthworks (movimientos de tierra) and uncontrolled burning were also carried out.The petitioner recounts that at the end of octubre de 2023 they reported these events to the respondent authorities, providing evidence not only of the encroachment and resulting environmental damage but also requesting that action be taken in response. The petitioner maintains that since then the encroachment and impacts have increased, as described in supplemental submissions to the respective complaints. The petitioner asserts that no response has been received from the respondent municipality. The petitioner adds that Minae’s SITADA, by email dated 22 de enero de 2024, advised them that the encroachments and environmental impacts had been verified; nevertheless, it merely filed a complaint with the Garabito prosecutor’s office. The petitioner states that, in response, they asked why no interim administrative action was being taken, such as removing the unauthorized access opened by the encroachers; however, there has been neither a response nor any enforcement action.The petitioner alleges that they notified the respondent municipality of earthworks and construction activity within the lagoon’s protected area and requested information and action concerning the regulations, construction, and subdivisions (fraccionamientos); nevertheless, they have received no response in that regard either. The petitioner explains that the respondent authorities’ inaction has allowed the encroachers to appropriate more of the area. The petitioner asserts that between 24 y 26 de enero de 2024, practically all of the remaining vegetation layer and flora and fauna were removed. The petitioner requests that the petition be granted and that, as an interim measure (medida cautelar), the respondent authorities be ordered to halt the work and block access.
  2. 2By a decision issued at 17:46 hours on 30 de enero de 2024, the Presidency of the Chamber initiated proceedings against Sinac and the Municipalidad de Garabito. In addition, it requested reports from the mayor, the president of the council, and the official in charge of Gestión Ambiental, all of the respondent local government, as well as from the head of the Área de Conservación Pacífico Central (Acopac) and the executive director of Sinac.
  3. 3In a filing added to the electronic case record on 6 de febrero de 2024, Jeffrey Hernández Espinoza, regional director of the Área de Conservación Pacífico Central del Sistema Nacional de Áreas de Conservación, submitted a report under oath in the following terms: “In response to the allegations made by the petitioner, the actions taken by the Área de Conservación Pacífico Central are detailed in technical report SINAC-ACOPACOSRO-PPC-020-2024, signed by official Paola Alvarado Lezama, head of the Prevención, Protección y Control, Vida Silvestre program of the oficina Subregional de Orotina, and forwarded by the Jefe Subregional de Orotina through official letter ACOPAC-OSRO-054-2024, which is set forth below: I hereby inform you of the actions taken in connection with the complaint entered in the Sistema Integrado de Tramite de Denuncias Ambientales under registration number SITADA 43570-2023.The complaint was addressed on 22 de noviembre de 2023, and the visual inspection record (acta de inspección ocular) was entered into the SITADA platform on the same day; the report was subsequently filed with the Fiscalía de Garabito on jueves 18 de enero de 2024 under report number SINAC-ACOPAC-OSRO-PPC-223-2023. To date, the judicial case number is unavailable because the Fiscalía de Garabito does not provide it when the report is submitted; consequently, the report has not been attached on the platform for follow-up by the Asesoría Legal. In addition to this complaint concerning Laguna Carrizal, other complaints have been addressed, including one filed with the same Fiscalía in 2021 in response to complaint SITADA 25424-2021, through report SINAC-ACOPAC-DRFVS055-2021, signed by official Gil Ruiz, judicial case [Valor 002]. Furthermore, in 2022, police report SINAC-ACOPAC-OSRO-551-2022, signed by me as a supplement to judicial case [Valor 002], was filed.Likewise, in 2021, official Adrian Arce signed report SINAC-ACOPAC-PINV-005-2022. All the reports relate to impacts caused by burning, both around Laguna Carrizal and in sectors that were registered under Nombre01 of the Asociación de vecinos de Bajamar. Furthermore, it is important to mention that, although Laguna Carrizal is located in an area adjacent to the coast, it lies within private property recorded under registration number a mbre01 d de ASOCIACION DE LA COMUNIDAD DE BAJAMAR CEDULA JURIDICA CED01. Additionally, with respect to the reported events, there has been no evidence or information from witnesses that would make it possible to identify the accused person or persons. As can be seen from the report forwarded by the oficina Subregional that handled the case, the complaint was fully addressed in compliance with Oficio Circular SINAC-SE-DE-356-2023, which sets forth the activities to be performed by SINAC enforcement and protection personnel.In addition, the filed complaint was assigned judicial case number [Valor 003], according to an inquiry made by the Asesoría legal del ACOPAC with the Fiscalía de Garabito. As to the petitioner’s statement regarding the adoption of interim administrative measures to eliminate the unauthorized access opened by the encroachers, such action falls outside SINAC’s jurisdiction and lies within the municipality’s jurisdiction. Request for Relief: That this petition for amparo be denied, because, as demonstrated, the Oficina Subregional del ACOPAC has taken the actions required by applicable regulations to address the situation by filing the corresponding environmental complaint (denuncia ambiental) with the Fiscalía de Garabito, and information has likewise been provided regarding the actions taken by the administration in the sector, as shown by the evidence submitted.”
  4. 4In a filing added to the electronic case record on 8 de febrero de 2024, David Chavarría Morales, acting executive director of Sinac, submitted a report under oath. He states as follows: “SECOND: That technical report SINAC-ACOPAC-OSRO-PPC020-2024, signed by official Paola Alvarado Lezama, head of the Prevención, Protección y Control, Vida Silvestre program of the oficina Subregional de Orotina, states as follows: ‘I hereby inform you of the actions taken in connection with the complaint entered in the Sistema Integrado de Tramite de Denuncias Ambientales under registration number SITADA 43570-2023. The complaint was addressed on 22 de noviembre de 2023, and the visual inspection record was entered into the SITADA platform on the same day; the report was subsequently filed with the Fiscalía de Garabito on jueves 18 de enero de 2024 under report number SINAC-ACOPACOSRO-PPC-223-2023. In addition, the filed complaint was assigned judicial case number [Valor 003], according to an inquiry made by the Asesoría legal del ACOPAC with the Fiscalía de Garabito.’ REQUEST FOR RELIEF: It is respectfully requested that the petition for amparo filed by Mr. Nombre02 be denied, because none of the protected party’s fundamental rights has been violated and the actions of the entity I represent have been carried out in accordance with the legal authority of the Sistema Nacional de Áreas de Conservación, given that the Área de Conservación Pacífico Central addressed the matter, filed the corresponding environmental complaint with the Fiscalía de Garabito, and took administrative action on the SITADA platform.”
  5. 5In a filing added to the electronic case record on 12 de febrero de 2024, Tobías Murillo Rodríguez, mayor of Garabito, submitted a report under oath in the following terms: “That through official letter SAM-046-2024, a response was (sic) provided to the petitioner at the email address that the petitioner supplied (sic).”
  6. 6In a certification dated 12 de febrero de 2024, Mariane Castro Villalobos and Orlando Loría Vargas, acting secretary and judicial technician 3, respectively, stated: “upon review, at thirteen hours eighteen minutes on doce de febrero de dos mil veinticuatro, of the received-document log and this case file in the Costa Rican judicial office management system, it did not appear that, from 05/02/2024 to 08/02/2024, the PRESIDENT OF THE MUNICIPAL COUNCIL AND THE OFFICIAL IN CHARGE OF ENVIRONMENTAL MANAGEMENT, BOTH OF THE MUNICIPALIDAD DE GARABITO, had submitted any brief or document for the purpose of providing the report requested of them in the ruling issued at seventeen hours forty-six minutes on treinta de enero de dos mil veinticuatro.”
  7. 7In a brief incorporated into the digital case file on 13 de febrero de 2024, the petitioner entered an appearance. He states: “1.- Upon Following Up on and Reviewing the Case File in this Matter, I have Seen the REPORTS REQUIRED BY LAW already Submitted by the MINAE, SINAC and ACOPAC Officials regarding the Status of my Complaint and the VERIFIED GREATER IMPACT ON THE ‘PROTECTED ZONE’ (zona protegida) OF THE LAGUNA CARRIZAL WETLAND (humedal). And I have Truly been Absolutely and Negatively Surprised by HOW the MINAE Officials (in the broad sense), DESPITE THE ENORMOUS BODY OF LEGAL RULES (POLITICAL CONSTITUTION, INTERNATIONAL TREATIES, FORMAL LAWS AND OTHER RULES); DESPITE ALL THEIR OBLIGATIONS, DUTIES, RESPONSIBILITIES, POWERS, JURISDICTION AND FACTUAL/LEGAL MEANS OF ACTION, State that THEY CONSIDER THEIR DUTIES FULFILLED BY CONDUCTING AN INSPECTION OF THE REPORTED SITE, DURING WHICH THEY VERIFY THE ENVIRONMENTAL DAMAGE (daño ambiental) AT ISSUE, WITHOUT ANY FOLLOW-UP WHATSOEVER TO DETERMINE HOW THE HARM TO AN IMPORTANT NATURAL SITE DEVELOPS, And then Filing a ‘Criminal Complaint’ (denuncia penal), the NUMBER of which THEY DO NOT EVEN KNOW afterward, AND ABANDONING IT BEFORE THE MINISTERIO PÚBLICO SO THAT IT (ALREADY OVERBURDENED WITH WORK) WILL BE THE ONE TO ‘HANDLE THE CASE,’ While they, from the Administrative Perspective, despite All the Legal Tools Available to Them and, as Stated, All their Statutory Responsibilities: DECIDE TO DO NOTHING, Allow Matters to Continue, JUST LIKE THAT.With the Greatest Possible Indifference and Negligence. THE RESPONSE FROM THE MINAE OFFICIALS AND WHAT THEY OPENLY ACKNOWLEDGE IS TRULY UNBELIEVABLE. GIVEN THOSE CONDITIONS AND OMISSIONS OF REQUIRED ACTION, WHAT IS MINAE FOR? It follows from the Statements of the Officials of this Ministry that THEY CAN DO NOTHING ADMINISTRATIVELY. When the Truth is that THEY DO NOT WANT TO DO ANYTHING! And it is in response to that IMPROPER Position that I Must React and Speak Out. I Ask this Honorable Chamber to Grant the Amparo Proceeding (amparo) and Order the MINAE Authorities to ACT Immediately, TO TAKE APPROPRIATE ACTION AND HALT, PROTECT AND TAKE CORRECTIVE ACTION REGARDING PUBLIC/STATE-OWNED LAND THAT IS IN THEIR CUSTODY AND IS AN ENVIRONMENTALLY PROTECTED ZONE, A WETLAND. WITH RESPECT TO WHICH THEY MUST TAKE ALL REQUIRED PROTECTIVE ACTION AND NOT MERELY, DESPITE HAVING VERIFIED THE REPORTED ENVIRONMENTAL DAMAGE DURING THEIR ‘INSPECTION’: TAKE NO ACTION WHATSOEVER THROUGH THE ADMINISTRATIVE CHANNEL THAT IS ENTIRELY WITHIN THEIR PURVIEW.Article 111 of the Organic Environmental Law (Ley Orgánica del Ambiente), No. 7554, continues by Expressly Stating: ...‘Violations of environmental legislation that do not fall within the jurisdiction of the Tribunal Ambiental Administrativo shall be heard by:1) The Ministerio de Ambiente y Energía (Minae) and the Contraloría Ambiental, through the Sistema Integrado de Trámite y Atención de Denuncias Ambientales (Sitada).2) The Secretaría Técnica Nacional Ambiental, when an administrative case file is open for the activity, work, or project in question.3) The municipality of the respective jurisdiction, when the matters concern construction permits.’ AND NOTWITHSTANDING THE FOREGOING, THE EXPRESS INTENTION OF THE MINAE OFFICIALS IS TO EVADE THEIR RESPONSIBILITIES AND POSSIBLE ACTIONS AND TO DO NOTHING EFFECTIVE WITHIN THE SCOPE OF THEIR ADMINISTRATIVE RESPONSIBILITIES. 2.- Together with and Related to the foregoing, given that MINAE and the Municipalidad de Garabito CONTINUE TO TAKE NO EFFECTIVE ACTION, the Persons who have ENCROACHED UPON and HARMED THE PROTECTED AREA OF ‘LAGUNA CARRIZAL’ CONTINUE THEIR IMPROPER ACTIONS. After a Couple of Weeks without Actions Affecting the Area, upon Seeing the Area THEY HAVE AFFECTED Growing Green Again, They Brought the Tractors Back in and Repeated the Earthworks (movimientos de tierras), Removing the Flora that Was Beginning to Grow Again and TAKING ACTION AGAINST THE NEIGHBORS WHO HAVE PROTESTED THEIR IMPROPER CONDUCT. They Placed Significant Amounts of Soil and Enormous Rocks against the Walls of Our Properties, Undermining and Damaging the Walls Belonging to Some of Us. This Was Done to Make It Completely Impossible for Us to Access the Public Area of the Lagoon. We Access that Area to Extinguish Small Uncontrolled Fires and Remove Waste and Trash Left by Visitors. WE CAN NO LONGER DO THIS, as Shown in the Photographs I Insert Below. IMAGES (ALL) CORRESPONDING TO LAST WEEK, FROM 4 TO 10 DE FEBRERO OF THE CURRENT YEAR: Photographs of New Actions Removing Flora and Fauna from the Area: (…) The foregoing is What I Am Able to Show and State. I Continue to Wait to See WHAT EXCUSE THE MUNICIPALIDAD DE GARABITO WILL COME UP WITH REGARDING ITS REPORTED FAILURE TO ACT AND ITS COMPLETE REFUSAL TO TELL US WHETHER OR NOT IT HAS ISSUED ANY PERMIT FOR ROAD CONSTRUCTION AND/OR URBAN DEVELOPMENT OR HOUSING CONSTRUCTION ON THE LAGUNA DE CARRIZAL LAND” (sic).
  8. 8In a written submission incorporated into the digital case file on 14 de febrero de 2024, the petitioner appeared and stated: “As the Plaintiff, Concerned about and Affected by Major Environmental Impacts that have occurred in the vicinity of the ‘Protected Zone’ of the ‘LAGUNA CARRIZAL’ Wetland, in light of what will be shown and stated, I most respectfully appear in order to explain and state the following: Upon Reviewing and Following Up on the Case File in this Matter, I have seen the meager STATUTORY REPORT (INFORME DE LEY) submitted PARTIALLY by the representatives of the Municipalidad de Garabito. In light of what it states, I believe it appropriate to point out and emphasize the following. 1.- First of All, neither the members of the Concejo Municipal nor the personnel of the Units dealing with Environmental and Construction Matters in the Municipality of the Canton of Garabito HAVE RESPONDED regarding my amparo proceeding (amparo).In complete disregard and disrespect of what was required by that Sala, they have once again failed to act concerning the serious environmental damage that We have reported and regarding which We have taken action before that Municipality, WITHOUT ANY SUBSTANTIAL OR PROPER RESULTS. 2.- For his Part, the Alcalde de Garabito submitted a ONE-LINE ‘Statutory Report,’ AND WHAT IT SAYS IS NEITHER CORRECT NOR TRUTHFUL. He states that ‘BY OFFICIAL LETTER SAM-046-2024, A RESPONSE WAS (SIC) PROVIDED TO THE PETITIONER AT THE EMAIL ADDRESS THAT HE HIMSELF SUPPLIED.’ This IS NOT TRUE. The referenced Official Letter is an Internal Document dated 6 de febrero del 2024, from the Área de Servicios Ambientales y Municipales to the Unidad de Gestión Jurídica of that Municipality, so that a Response could be provided to Our amparo proceeding. IT IS NOT A DOCUMENT ADDRESSED TO THE UNDERSIGNED, NOR DOES IT CONTAIN AN ADEQUATE RESPONSE TO MY COMPLAINTS; FURTHERMORE, IT WAS NEVER SENT TO US AT THE EMAIL ADDRESS PROVIDED FOR THAT PURPOSE.Moreover, WHAT IS SOUGHT IS NOT A RESPONSE ON PAPER, BUT THE REQUIRED ACTIONS, IN ACCORDANCE WITH THE MUNICIPALITY’S POWERS, RESPONSIBILITIES, DUTIES, OBLIGATIONS, AND AUTHORITY, TO PROTECT THE ENVIRONMENT AND RESTRICT THE CONSTRUCTION OF ACCESS ROUTES, INTERNAL ROADS, AND STRUCTURES WITHIN THE PROTECTED AND RESERVE AREA OF LAGUNA CARRIZAL. THEY CONTINUE TO FAIL TO DO SO. This violates the provisions of Section 111 of the Ley Orgánica del Ambiente, No. 7554, which expressly continues to state: …‘Violations of environmental legislation that do not fall within the jurisdiction of the Tribunal Ambiental Administrativo shall be heard by:1) The Ministerio de Ambiente y Energía (Minae) and the Contraloría Ambiental, through the Sistema Integrado de Trámite y Atención de Denuncias Ambientales (Sitada).2) The Secretaría Técnica Nacional Ambiental, when an administrative case file has been opened for the activity, work, or project in question.3) The municipality of the respective jurisdiction, when the matters relate to construction permits.’… 3. Upon Reviewing the Contents of Document No. SAM-046-2024, referenced above and submitted as ‘EVIDENCE’ for the Scant Statutory Report filed by the Alcalde Municipal, We Find the Following: - They Begin by ‘Passing the Buck’ and Claiming that it is a MINAE Matter, DISREGARDING ALL THEIR OBLIGATIONS AND RESPONSIBILITIES REGARDING ENVIRONMENTAL MATTERS AND UNLAWFUL CONSTRUCTION. - They FALSELY state that on 29 de enero of this year, They Responded to Our Attorney’s Email: [...]. THIS IS NOT TRUE. Engineer Johan Ramírez asked Our Attorney for his Telephone Number in order to Tell Him that My Complaint had to be Directed to MINAE and NOT TO THE MUNICIPALITY. In response to that Improper Action, Our Attorney replied: …‘Engineer, good afternoon. Please forgive me for only now responding to your email, but at my Client’s request, I have been occupied today with filing an Amparo so that the various administrative authorities with powers, duties, responsibilities, and obligations in this matter may be compelled by the Sala Constitucional to act. SITANA has already reviewed the matter and filed a Criminal Complaint. But that action relates ONLY to potential Criminal liability for the damage to the Wetland. FROM THE STANDPOINT OF ADMINISTRATIVE POWERS, THEY ARE ALSO REQUIRED TO ACT, WHETHER SITANA ITSELF OR THE SINAC/MINAE OFFICES. From the Municipal standpoint, the NOTICES posted by the Encroachers advertise a Real Estate Development. Roads have been opened and an Unlawful Access Route has been created at the End of a Public Road, preparing the land for Construction??? We have requested that we be informed whether that Municipality has issued any Construction Permits (WITHOUT RECEIVING ANY RESPONSE). Therefore, insofar as that Municipality is concerned, if it has an Environmental Office, that office exists for a reason. FURTHERMORE, IN ALL OTHER AREAS INVOLVED, THAT MUNICIPALITY IS THE AUTHORITY REQUIRED TO TAKE ACTION AND SHUT DOWN UNAUTHORIZED CONSTRUCTION, ESPECIALLY IN A PROTECTED AND PUBLIC AREA, AND TO RESTRICT ACCESS ON PUBLIC ROADS DESIGNATED AS DEAD ENDS. In short, and with all due respect, we believe that, in accordance with their Various Statutory Powers, Duties, Authority, Obligations, and Responsibilities, we have submitted our Initial Requests to the appropriate bodies. AND THEY MUST ACT WITHIN THEIR RESPECTIVE POWERS.’… As Evidence of What Actually Occurred, the Relevant Email Exchange is Attached. IT IS ABUNDANTLY CLEAR THAT THE REFERENCED EMAILS CONTAIN NEITHER AN ADEQUATE RESPONSE NOR THE REQUIRED ACTIONS CONCERNING MY ENVIRONMENTAL COMPLAINT. - Finally, it is apparent that They Visited the Site and Acknowledge that Construction-Related and Environmental Impacts Exist. BUT THEY DID NOTHING. They say that an Area Immediately Adjacent to the LAGUNA CARRIZAL Wetland is ‘PRIVATE’ and that THEY CANNOT ENTER OR DO ANYTHING. This IS NEITHER PERMISSIBLE NOR TRUE. THE AFFECTED AREA CAN NEVER BE PRIVATE IN NATURE. IT MAY BE LOCATED WITHIN PRIVATE PROPERTY, BUT THE LAGOON IS FORMED AS AN EXTENSION OF THE SEA’S INTRUSION TOWARD THE COAST AND IS, PER SE, SUBJECT TO THE LEY DE ZONA MARÍTIMO TERRESTRE AND THE REQUIRED SETBACKS (RETIROS), UNDER THAT LAW OR THE ENVIRONMENTAL REGULATIONS APPLICABLE TO THE MATTER (Waters). FURTHERMORE, IT IS A MANGROVE AREA. THE VERY PLAT FOR THE PROPERTY TO WHICH THEY REFER SETS FORTH THE APPLICABLE RESTRICTIONS AND RESERVATIONS: (…) IT IS ALSO ACKNOWLEDGED THAT NO CONSTRUCTION PERMIT WHATSOEVER HAS BEEN ISSUED FOR THE AREA COVERED BY THE COMPLAINT. And it is Paradoxical and Entirely Contradictory for Them to say that THEY ARE DOING NOTHING, while REFERENCING A CLOSURE ORDER (ACTA DE CLAUSURA) FROM THE YEAR 2021 CONCERNING THE PROPERTIES ADJACENT TO THE AFFECTED LAGOON. THIS PROVES THAT THEY CAN INDEED SHUT DOWN THE ILLEGAL ACCESS WORKS, INTERNAL ROADS, AND REMOVAL OF TREES AND VEGETATIVE COVER (CONSTRUCTION WORK), AS WELL AS THE DESTRUCTION OF FAUNA, ALL OF WHICH HAVE BEEN CARRIED OUT WITHOUT ANY PERMIT, ILLEGALLY, AND TO THE DETRIMENT OF THE ENVIRONMENT. THEREFORE: WHY DO THEY NOT DO SO? THIS IS TOTAL NEGLECT. The foregoing is what I deem Appropriate to State and Emphasize. I ask that You Take it into Consideration for the Purpose of GRANTING My Amparo Proceeding, WITH ALL LEGAL EFFECTS.”
  9. 9The statutory requirements have been observed in the proceedings conducted.

Justice Rueda Leal drafts the opinion; and,

Whereas:

I.Preliminary matter. Given that the president of the Concejo and the head of Gestión Ambiental, both of the municipalidad de Garabito, failed to submit the requested report within the period granted, pursuant to article 45 of the Ley de la Jurisdicción Constitucional, the alleged facts are deemed true with respect to these authorities, and the appeal shall be decided based on the remaining evidence contained in the case file.

II.Subject matter of the appeal. The plaintiff states that several years ago he acquired land in the area adjacent to and bordering Laguna de Carrizal, in the Bajamar sector of Garabito de Puntarenas, which is a recognized wetland forming part of the Paso Las Lapas biological corridor (corredor biológico). He asserts that encroachment upon the lagoon’s protected area began in that location, along a dead-end road terminating at its boundary; an unauthorized access route was opened, and work began to remove both the vegetative layer (capa vegetal) and the flora and fauna. Earthworks (movimientos de tierra) and uncontrolled burning were also carried out. He recounts that at the end of octubre de 2023 he reported what had occurred to the respondent authorities and not only presented evidence of the encroachment and resulting environmental damage, but also requested that action be taken in response.

He maintains that, since then, the encroachment and resulting impacts have increased, as set forth in supplemental submissions to the respective complaints. He alleges that he has received no response from the municipality. The response of the respondent municipality. He adds that SITADA of MINAE informed him by email dated 22 de enero de 2024 that it had confirmed both the encroachments and the environmental impacts and that it merely filed a complaint with the fiscalía de Garabito. He states that, in response, he asked why no interim administrative measure (medida cautelar en vía administrativa) was being taken, such as removing the unlawful access route opened by the encroachers; however, there has been neither a response nor any enforcement action. He alleges that he notified the respondent municipality of earthworks and construction activities in the lagoon’s protected area and requested information and action from the standpoint of the regulations governing construction and subdivisions (fraccionamientos); nevertheless, he received no response.

He explains that the respondent authorities’ inaction has allowed the encroachers to seize more of the area. He states that between 24 and 26 de enero de 2024, practically all of the remaining vegetative layer, flora, and fauna were eliminated. He asks that the appeal be granted and that, as an interim measure (medida cautelar), the respondent authorities be ordered to halt the work and block access.

III. Proven facts. The following facts are deemed duly established and relevant to the determination of this matter

  • a)With respect to SINAC:

i. On 25 octubre de 2023, through the Integrated Environmental Complaint Processing System (Sistema Integrado de Trámite de Denuncias Ambientales, Sitada) of the Environmental Comptroller’s Office (Contraloría Ambiental) of MINAE, a complaint was filed under Nombre01 of the protected party, addressed to “Messrs. Sistema Nacional de Áreas de Conservación (SINAC), MINISTERIO DEL AMBIENTE Y ENERGÍA (MINAE), Present; Messrs. Sistema de Área de Conservación Pacífico Central (ACOPAC), Sistema Nacional de Áreas de Conservación (SINAC), MINISTERIO DEL AMBIENTE Y ENERGÍA (MINAE) (…)” with the following content: “(…) I appear for the purpose of filing this COMPLAINT concerning highly possible situations of ‘Impact’ on the LAGUNA CARRIZAL WETLAND. And for the purposes of this Submission, I Make the Following Statements: PRELIMINARY CLARIFICATION: This Submission Is Addressed to All Your (Administrative) Authorities, by Virtue of the obligations, Duties, Responsibilities and Powers that by Law (in the broad sense) They Have for the purpose of Intervening and Taking Actions for the Oversight, Protection and Punishment of the Significant Environmental Matter Involved in this Complaint.

Therefore, on the Merits thereof, Each and Every One of the Recipient Agencies before which this Submission is Made has an Obligation to Act (Arts. 11, 27, 30, 41, 50 y 129 de la Constitución Política). REGARDING THE WETLAND IN QUESTION: From what we have Been Able to Verify, LAGUNA DE CARRIZAL is indeed a Recognized Wetland (humedal), which Forms Part of Corredor Biológico Paso las lapas. It Is Located in Distrito de Tárcoles, Cantón de Garabito, Provincia de Puntarenas. Hoja Cartográfica BARRANCA. Latitud: 9º 50´13” y Longitud 64º 40’ 40”. (…) REGARDING THE BASIS OF MY COMPLAINT: As I already stated, although I am a Merchant in San José, for Several Years I Have Been the Lawful Owner/Usufructuary of a Parcel of Land in the Carrizal Area. Its Western Boundary Adjoins the Laguna de Carrizal Area. Access to my Property is by what was a Dead-End Street, WHICH ENDS AT THE AFOREMENTIONED WETLAND, WITHOUT PROVIDING ANY ACCESS THERETO.

(…) First, a few Weeks ago, a Group of Persons whose identity I Do Not Know Came and Constructed an ACCESS GATE TO THE WETLAND AREA AT THE END OF THE AFOREMENTIONED DEAD-END STREET. Subsequently, these same Persons Began Carrying Out Burns in the Wetland Area. I DO NOT KNOW HOW THESE AFFECT THIS PROTECTED AREA (zona protegida). And a Few Days ago, the Persons in question Contacted me to Offer to SELL me and/or Develop the Area Behind or to the Rear of my Property, which I Have Identified as Part of the Laguna Carrizal Wetland. Such Acts Clearly Constitute an Occupation and Potential Urban Development of the Aforementioned Wetland Area. And This is what Leads me to Apply to your Authorities, as Necessary and/or Potential Participants, regarding Any Situation Related to said Protected Area. (…) REQUEST FOR PROCESSING, INVESTIGATION AND INFORMATION: 1. In view of what is Reported and Complained of herein to All Your Authorities, YOU ARE HEREBY PLACED ON NOTICE, for All Legal and Mandatory Purposes, including your Responsibilities for Omission or Failure to Perform your Functions, Powers and Duties (Potential Gross Fault and/or Negligence).

This applies if the Potential Encroachment upon and/or Impact on the Wetland that Is the Subject of this Complaint is Allowed or Tolerated through Omission. 2- With regard to the MINAE Authorities to which this Complaint is Submitted, All Investigative, Oversight, Safeguarding and Enforcement Actions are Requested in connection with the Matter Complained of and the Effective Protection of the Wetland that Is the Subject of this Complaint. And that the Opening of an Improper Access Point (Gate) to the aforementioned Wetland be investigated and acted upon. (…) AND WITH REGARD TO ALL RECIPIENTS OF THIS COMPLAINT, THE UNDERSIGNED HEREBY BECOMES A DIRECTLY INTERESTED PARTY AND REQUESTS THAT WE BE PROVIDED WITH A RESPONSE AND INFORMATION REGARDING THE ACTIONS TAKEN BY THOSE AGENCIES WITHIN THE TIME LIMITS PRESCRIBED BY LAW. AWAITING A PROPER AND EFFECTIVE RESPONSE (ARTS. 27, 30 Y 41 DE LA CONSTITUCIÓN POLÍTICA).

NOTICES: I Will Receive Them at the Email Address of my Attorney. Lic. Mario Quesada Aguirre. [...]. San José, 24 de Octubre del 2023” (sic). (Evidence submitted by the appellant and the SINAC authorities).

ii. The claimant’s complaint entered into Sitada was assigned registration no. 43570-2023. (Evidence submitted by the appellant and the SINAC authorities).

iii. ACOPAC, through the visual inspection record (acta de inspección ocular) issued at 8:41 hours on 22 de noviembre de 2023, placed the following on record: “An inspection is conducted to address a complaint entered into Sitada concerning encroachment upon the protection area (área de protección) of Laguna Carrizal; the complaint mentions the installation of an access gate to the Laguna. During this inspection, the reported facts are verified, and coordinates, measurements, and photographs are taken. In addition, a road running parallel to the Laguna is found, apparently constructed using machinery. What was found within the protection area of the Laguna consists of a black wooden and metal gate measuring 5 metros wide by 1.40 m high; a cement-and-ceramic wall next to the gate measuring 2.28 m wide by 1.61 m high; and a barbed-wire fence measuring 9 m wide, perpendicular to the edge of the Laguna. The road located next to the gate and extending east measures 60 m long by 4.30 m wide. That is all.” (Evidence submitted by the SINAC authorities).

iv. On 22 de enero de 2024, the person in charge of the Programa Prevención, Protección y Control of the Enlace Programa Vida Silvestre at the Oficina Subregional de Orotina of ACOPAC of SINAC communicated the following to the email address [...]: “I hereby inform you that the complaint entered into SITADA under registration number 43570-2023 was addressed (see the visual inspection record entered on the platform), and the report was filed with the Fiscalía de Garabito on jueves 18 de enero de 2024 under report number SINAC-ACOPAC-OSRO-PPC-223-2023. We do not have the judicial case-file number (número de expediente judicial), because the Fiscalía de Garabito does not provide us with the number (sic) when the report is submitted. I also consider it important to mention that, concerning the case in question, a complaint was filed with the same Fiscalía in 2021 in response to SITADA complaint 25424-2021, through report SINAC-ACOPAC-DRFVS-055-2021, signed by official Gil Ruiz, judicial case file [Valor 006].

In addition, in 2022, police report SINAC-ACOPAC-OSRO-551-2022, signed by me as an expansion of judicial case file [Valor 002], was filed. Likewise, in that same year, official Adrian (sic) Arce signed report SINAC-ACOPAC-PINV-005-2022. All the reports concerned impacts caused by burns both around Laguna Carrizal and in sectors that were under Nombre01 of Asociación de vecinos de Bajamar. Finally, I inform you that, as of this date, the status of said proceeding or proceedings is unknown.” (Evidence submitted by the appellant and the SINAC authorities).

v. The person in charge of the Programa de Prevención, Protección y Control of the oficina Subregional Orotina of Área de Conservación Pacífico Central stated the following in official letter (oficio) SINAC-ACOPAC-OSRO-PPC-020-2024 of 1º de febrero de 2024: “The complaint was addressed on 22 de noviembre de 2023, and the corresponding visual inspection record was entered into the SITADA platform on that same day. Subsequently, the report was filed with the Fiscalía de Garabito on jueves 18 de enero de 2024 under report number SINAC-ACOPAC-OSRO-PPC-223-2023. To date, the judicial case-file number is unavailable because the Fiscalia (sic) de Garabito does not provide us with the number when the report is submitted; consequently, said report has not been attached to the platform for follow-up by the Asesoría Legal. In addition to the present complaint concerning Laguna Carrizal, other complaints have been addressed, and a complaint was filed with the same Fiscalia (sic) in 2021 in response to SITADA complaint 25424-2021, through report SINAC-ACOPAC-DRFVS-055-2021, signed by official Gil Ruiz, judicial case file [Valor 007].

In addition, in 2022, police report SINAC-ACOPAC-OSRO-551-2022, signed by me as an expansion of judicial case file [Valor 002], was filed. Likewise, in 2021, official Adrian (sic) Arce signed report SINAC-ACOPAC-PINV-005-2022. All the reports concern impacts caused by burns both around Laguna Carrizal and in sectors that were under Nombre01 of Asociación de vecinos de Bajamar. Furthermore, it is important to mention that, although Laguna Carrizal is located in an area adjacent to the coast, it lies within private property registered under land-record number (número de matrícula) a mbre01 d de ASOCIACION (sic) DE LA COMUNIDAD DE BAJAMAR CEDULA (sic) JURIDICA (sic) 3-002-320413. Additionally, with respect to the reported acts, no evidence or witness information has been obtained that would make it possible to identify the accused person or persons (persona o personas imputadas).” (Evidence submitted by the SINAC authorities).

vi. Official letter SINAC-ACOPAC-OSRO-PPC-223-2023 dated 29 de diciembre de 2023, addressed to the Fiscalía de Garabito, states: “SUBJECT: Report of environmental damage. Dear Sirs/Madams: I, the undersigned, Stephanie Paola Alvarado Ledezma (…) an official of the Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, acting in the capacity of a law-enforcement authority pursuant to Article 54 of the Ley Forestal and Article 16 of the Ley de Vida Silvestre, assigned in accordance with case law to the Oficinal Sub Regional de Orotina, appear before your authority for the purpose of reporting the following acts against Natural Resources, as detailed below: 1. FACTS. FIRST: A complaint (denuncia) was received through the Sistema Integrado de Tramite (sic) de Denuncias Ambientales (SITADA), containing an attached document that mentions harm to the Laguna Carrizal wetland (humedal), located in Bajamar, Tárcoles, Garabito.

SECOND: Therefore, on 22 de noviembre de 2023 at 08:40 hours, the complaint was investigated in the company of officials from the Unidad Ambiental del Servicio Nacional de Guardacostas de la Estación de Caldera. THIRD: At the site, located on the north side of Laguna Carrizal, there is a black wooden and metal gate measuring 5 meters wide by 1.40 m high; next to the gate is a cement and ceramic wall measuring 2.28 m wide by 1.61 m high. FOURTH: A barbed-wire fence 9 m long was also found, positioned perpendicular to the edge of the lagoon. FIFTH: A road opening, apparently made with machinery, was also found. It begins next to the gate described above and runs parallel to the edge of the lagoon, measuring 60 m long by 4.30 wide. SIXTH: The features found during this inspection are located within the protection area (area (sic) de protección) of Laguna Carrizal (50 m), as may be seen in Figure 1.

SEVENTH (sic): According to the verification of coordinates using the Quantum GIS program and the information contained in the SNIT (Sistema Nacional de Información Territorial) property-registry information layers of the Registro Nacional, the property on which the road was constructed is registered under property number 45588---000 in the name of Nombre01 of [Nombre01 003], identity card (Cedula (sic) identidad) [CED02], [Nombre 004], identity card [CED03], [Nombre 005], identity card [Valor 010], [Nombre 006] (sic), identity card [Valor CED05]. EIGHTH: Moreover, the gate is located in an area (area (sic)) where a public road ends, according to the public-road information layer. NINTH: This inspection detected not only what Mr. [Nombre01 001] reported, but also that the property adjoining the location of the reported acts has a cement wall, 96 m of which lies within the protection area of Laguna Carrizal, as well as two buildings within the protection area.

This could be observed by reviewing the coordinates and using the Google Satellite image, because the property was closed and could not be clearly observed in the field. TENTH (sic): The wall and the two buildings are located on the property with registration number , in the name01 d of [Nombre 007] (sic), identity card [Valor D06],], [mbre01 0 008], identity card [Valor D07]”]”. (Evidence submitted by the appellant and the SINAC authorities).

  • b)Regarding the Municipalidad de Garabito:

i. In October 2023, the Municipalidad de Garabito received a complaint in the Name01 of the protected party addressed to “Mr. Municipal Mayor and Members of the Municipal Council (sic), MUNICIPALIDAD DE GARABITO. Present. Sirs/Madams, Technical Services and Environmental Services Units, MUNICIPALIDAD DE GARABITO (…)” with the following content: “(…) I hereby Appear for the Purpose of Filing this COMPLAINT regarding Highly Possible instances of ‘Harm’ to the LAGUNA CARRIZAL WETLAND. For the purposes of this Filing, I Set Forth the Following Considerations: PRELIMINARY CLARIFICATION: This Filing is Directed to All of Your (Administrative) Authorities, in Light of the obligations, Duties, Responsibilities, and Powers Conferred on Them by Law (in the broad sense) to Intervene and Take Measures of Oversight, Protection, and Sanction regarding the Significant Environmental Issue Raised by this Complaint.

Accordingly, Each and Every One of the Recipient Agencies before which this Filing is made has an Obligation to Act (Arts. 11, 27, 30, 41, 50 and 129 of the Constitución Política). REGARDING THE WETLAND AT ISSUE: Based on what we have been Able to Verify, LAGUNA DE CARRIZAL is indeed a Recognized Wetland that Forms Part of the Corredor Biológico Paso las lapas. It is Located in the District of Tárcoles, Canton of Garabito, Province of Puntarenas. BARRANCA Map Sheet. Latitude: 9º 50´13” and Longitude 64º 40’ 40”. (…) REGARDING THE BASIS OF MY COMPLAINT: As I already stated, although I am a Merchant in San José, for Several Years I Have Been the Rightful Owner/Usufructuary of a Parcel of Land in the Carrizal Area. Its Western Boundary Adjoins the Laguna de Carrizal Area. Access to my Property is by what was a Dead-End Street, which ENDS AT THE AFOREMENTIONED WETLAND WITHOUT PROVIDING ANY ACCESS TO IT.

(…) First, a few Weeks ago, a Group of Persons whose identity I Do Not Know Came and Constructed an ACCESS GATE TO THE WETLAND AREA AT THE END OF THE AFOREMENTIONED DEAD-END STREET. These same Persons then Began Conducting Burns in the Wetland Area, WHICH I DO NOT KNOW TO WHAT EXTENT AFFECT THIS PROTECTED AREA. And a few Days ago, the Persons in question Contacted me to Offer to SELL me and/or Develop the Area Behind or to the Rear of my Property, which I Have Identified as Part of the Laguna Carrizal Wetland. These Acts clearly indicate Occupation and Potential Urban Development within the Aforementioned Wetland Area. This is what Leads me to Apply to your Authorities as Necessary and/or Potential Participants regarding any Situation Related to said Protected Area. (…) REQUEST FOR PROCESSING, INVESTIGATION, AND INFORMATION: 1. In view of what is Reported and Complained of herein to All of your Authorities, YOU ARE HEREBY PLACED ON NOTICE for All Legal and Mandatory Purposes, including your Liability for Omission or Failure to Perform your Functions, Powers, and Duties (Potential Gross Fault and/or Negligence).

ii. The acting coordinator and the acting senior process analyst, both from Servicios Ambientales y Municipales of the Municipalidad de Garabito, stated as follows in official letter SAM-477-2023 dated 31 de octubre de 2023, addressed to “Tobías Murillo Rodríguez, Municipal Mayor, Municipalidad de Garabito”: “Regarding the request made through Official Letter AMI-2237-2023-TM in connection with miscellaneous-document form 41648-41647: ‘I am forwarding a copy of miscellaneous-document form 41648-41647, signed by Mr. [Nombre01 002] (sic) [Nombre01 001], formally submitting a complaint regarding harm to the Laguna Carriza wetland, so that, within 10 business days, you may prepare a report thereon and notify the person concerned.’ Accordingly, you are hereby informed that the complaint was entered into the Sistema Integrado de Trámite de Denuncias Ambientales (SITADA), administered by the Contraloría Ambiental, in which the Municipalidad de Garabito has a user account.

It should be noted that the complaint is identified by code 43570-2023 and was assigned by the Contraloría Ambiental to the Sistema Nacional de Áreas de Conservación del Área de Conservación Pacífico Central (SINAC-ACOPAC), because it is the MINAE agency with jurisdiction over complaints concerning wetlands. This is because it has experts in the field, unlike the Municipalidad de Garabito. Therefore, SINAC will conduct the corresponding investigation, and, as required, the Departamento de Servicios Ambientales y Municipales will provide the necessary support within the scope of its authority to address the case (…)”. (Evidence submitted by the mayor of Garabito).

iii. The acting coordinator and the acting senior process analyst, both from Servicios Ambientales y Municipales of the Municipalidad de Garabito, stated as follows in official letter SAM-046-2024 dated 6 de febrero de 2024, addressed to “Sirs/Madams, Gestión Jurídica, Municipalidad de Garabito”: “This is to inform you of the actions taken by the Departamento de Servicios Ambientales y Municipales regarding the complaint filed by Mr. [Nombre01 001]: • On 31 de octubre del 2023, through official letter SAM-477-2023, a response was sent to the request submitted in official letter AMI-2297-2023›TM at the email address ...01. It informed him that the complaint had been entered into the Sistema Integrado de Trámite y Atención de Denuncias Ambientales (SITADA) and assigned to the Sistema Nacional de Áreas de Conservación (SINAC) for handling. • On 29 de enero del 2024, a response was sent to one of the emails originating from the address [...] from the email accounts ...02 and ...03.

He was asked to provide a telephone number at which he could be contacted so that we could offer the corresponding assistance within the scope of our authority. • On 6 de febrero del 2024, an inspection was conducted at the indicated site together with Lic. Jason Angulo of the Departamento de Servicios Técnicos – Zona Marítima Terrestre and Inspector Vanessa Camacho of the Departamento de Seguridad y Convivencia Social. The property apparently corresponds to property 0045251, private property that was not entered because no one was present at the site to allow us access. Nevertheless, the existence of municipal permits was verified, and none exist. The records also contain Closure Record (Acta de clausura) 0079-2021, issued in 2021. (…) Official Letter SAM-477-2023 and proof of the emails sent in response are attached.” (Evidence submitted by the mayor of Garabito).

IV.Unproven fact (hecho no probado). Of significance to the determination of this matter, it is deemed unproven that the Municipalidad de Garabito notified any response through the contact method specified by the appellant in the filing made in October 2023.

V. Regarding constitutional principles in environmental matters

Concerning the preventive and precautionary principles (principios preventivo y precautorio), in judgment no. 2021024807 at 9:20 hours on 5 de noviembre de 2021, this Chamber stated:

“In this regard, specialized legal scholarship has stated that the preventive principle (principio preventivo) requires that, when there is certainty regarding possible harm to the environment, the activity causing such harm must be prohibited, limited, or made conditional upon compliance with certain requirements. In general, this principle applies when risks are clearly defined and identified as at least probable; likewise, this principle is useful when there are no technical reports or administrative permits guaranteeing the sustainability of an activity, but sufficient grounds exist to anticipate potential adverse impacts. The precautionary principle (principio precautorio), in turn, provides that, where there is a threat of serious and irreversible harm, lack of absolute scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.

It follows from the foregoing that the principle is based on reasonable scientific uncertainty coupled with the threat of serious and irreversible environmental harm (daño ambiental). Generally speaking, a significant difference between the preventive and precautionary principles lies in the level of knowledge and certainty concerning the risks posed by an activity or project. Whereas such certainty exists under the former, the latter involves a state of doubt resulting from scientific information or technical studies (…)” Indeed, the precautionary principle must be understood as set forth in Principle 15 of the Rio Declaration on Environment and Development: “Where there are threats of serious or irreversible damage, lack of absolute scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.” In other words, it does not require scientific studies establishing the “absolute certainty” that an activity is harmless to the environment—total safety is, as a matter of principle, scarcely attainable—but rather means that, even if the threat of serious or irreversible harm to the environment has not been fully established, such uncertainty can never justify or excuse postponing the implementation of effective measures to prevent environmental degradation.

In this regard, it should be noted, first, that this does not concern just any type of threat, since it must plausibly involve a serious danger, and, second, that the measure requires the effective and efficient use of the resources employed. Accordingly, although the precautionary principle is linked to a certain degree of scientific uncertainty, this does not mean that it may be applied without restriction on the ground that any activity could harm the environment, which would distort its underlying purpose. Rather, there must be some degree of identification of the risks of serious or irreversible harm that could arise, the determination of which varies according to the particular circumstances of each case. Thus, when a situation requires application of the precautionary principle, public entities and bodies must refrain from authorizing, approving, or permitting any new application or application for modification that reasonably entails a serious risk; they are even required to suspend activities already under way. At the same time, they must efficiently and effectively adopt all measures required to preserve a healthy and ecologically balanced environment (ambiente sano y ecológicamente equilibrado).

That principle is likewise embodied in a source of hard law, insofar as Principle 3 of the United Nations Framework Convention on Climate Change—ratified by Costa Rica through law no. 7414 of June 13, 1994 and by all OAS Member States—provides:

“3. The Parties should take precautionary measures to anticipate, prevent, or minimize the causes of climate change and mitigate its adverse effects. Where there are threats of serious or irreversible damage, lack of full scientific certainty should not be used as a reason for postponing such measures, taking into account that policies and measures to address climate change should be cost-effective so as to ensure global benefits at the lowest possible cost. To that end, such policies and measures should take into account different socioeconomic contexts, be comprehensive, cover all relevant sources, sinks, and reservoirs of greenhouse gases, and encompass all economic sectors. Efforts to address climate change may be carried out cooperatively by interested Parties.” The precautionary principle is also provided for in the Stockholm Convention on Persistent Organic Pollutants, which has been ratified by 32 OAS Member States, including Costa Rica—see law no. 8538 of August 23, 2006—which reads:

“ARTICLE 1 Objective Mindful of the precautionary approach enshrined in Principle 15 of the Rio Declaration on Environment and Development, the objective of this Convention is to protect human health and the environment from persistent organic pollutants (…).” Likewise, this principle is contemplated in the Convention on Biological Diversity, ratified by 34 OAS Member States, including Costa Rica, through law no. 7416 of June 30, 1994, whose preamble provides: “(…) Noting that it is vital to anticipate, prevent, and address at their source the causes of significant reduction or loss of biological diversity. Noting also that where there is a threat of significant reduction or loss of biological diversity, lack of unequivocal scientific evidence should not be invoked as a reason for postponing measures intended to avoid or minimize such a threat (…).” Consistent with the aforementioned regulations in force in the country, the Inter-American Court of Human Rights also addressed the precautionary principle in Advisory Opinion OC 23/17 of November 15, 2017:

“180. (…) Por tanto, this Court understands that States must act in accordance with the precautionary principle in order to protect the rights to life and personal integrity in cases where there are plausible indicators that an activity could cause serious and irreversible harm to the environment, even in the absence of scientific certainty. Por tanto, States must exercise due caution to prevent possible harm. Indeed, in the context of protecting the rights to life and personal integrity, the Court considers that States must act in accordance with the precautionary principle and must therefore, even in the absence of scientific certainty, adopt measures that are ‘effective’ in preventing serious or irreversible harm.” Following that decision, in a judgment in Indigenous Communities Members of the Lhaka Honhat (Our Land) Association v. Argentina, the Corte IDEH held on February 6, 2020, as follows: “the right to a healthy environment ‘must be considered included among the rights [...] protected by Article 26 of the American Convention,’ given the obligation of States to achieve the ‘integral development’ of their peoples, arising from Articles 30, 31, 33, and 34 of the Charter.” Of great significance, it must be emphasized that, in this ruling, the Corte IDH refers to Advisory Opinion no. OC-23/17 for the purpose of developing the content and scope of that right, by virtue of which the legal considerations set forth in the latter have logically acquired the binding legal force inherent in a judgment.

In this regard, the international court reiterates “that the right to a healthy environment ‘constitutes a universal interest’ and ‘is a fundamental right for the existence of humankind,’ and that ‘as an autonomous right [...] it protects the components of the [...] environment, such as forests, seas, rivers, and others, as legal interests in themselves, even in the absence of certainty or evidence regarding risks to individuals. It concerns protecting nature,’ not only because of its ‘usefulness’ or ‘effects’ with respect to human beings, ‘but also because of its importance to the other living organisms with which the planet is shared.’ The foregoing does not preclude, of course, the possibility that other human rights may be violated as a consequence of environmental harm.” Specifically, in developing the concept of the right to the environment, the Corte IDH clearly details the obligations of States in the face of possible harm to the environment, such as the duty of prevention (deber de prevención), the precautionary principle, the duty to cooperate (obligación de cooperación), and access to information (acceso a la información).

In short, application of the precautionary principle means that, where there are indications that a particular activity could plausibly cause serious and irreversible harm to the environment, the lack of absolute scientific certainty or evidence in that regard does not relieve the obligation to adopt all efficient and effective measures to prevent an infringement of the right to the environment.

Regarding the preventive principle, the first UN report on the state of international environmental law, document A/73/419 of November 30, 2018, prepared by the Secretary-General in compliance with the General Assembly resolution of May 10, 2018 (no. A/72/L.51), conceptualizes it as a normative rule of customary international law “confirmed by relevant practice in numerous environmental treaties and major codification projects.” Although the aforementioned report emphasizes the prevention of transboundary harm (prevención del daño transfronterizo), this general principle of law, as duly stated in the document “95 Environmental Legal Principles for Ecologically Sustainable Development” (approved at the 19th Ibero-American Judicial Summit—2018 and by the Corte Plena in Article XIX of session no. 28-2020 of May 25, 2020), has a much broader scope because, as a hermeneutic guide (guía hermenéutica), it dictates that “the causes and sources of environmental problems shall be addressed as a priority and in an integrated manner, seeking to prevent any adverse effects that may be produced on the environment.

The criterion of prevention shall therefore prevail over any other criterion in the public and private management of the environment and natural resources.” The foregoing is entirely logical, since it is consistent with the duty to prevent environmental harm from occurring, rather than merely deciding how to remedy harmful consequences that have already been established, including by ordering the cessation of the harmful effects.

This legal doctrine (instituto) is reflected, among other provisions, in Article 194.1 of the United Nations Convention on the Law of the Sea (ratified by Costa Rica through law no. 7291) and Article 5 and Annex II of the United Nations Fish Stocks Agreement concerning Straddling and Highly Migratory Fish Stocks (ratified through law no. 8059), as well as in constitutional case law (see judgments nos. 2021024807 at 9:20 a.m. on November 5, 2021 and 2018016383 at 5:00 p.m. on September 28, 2018, among many others) and treaty-based case law, for example Advisory Opinion no. OC-23/17 of November 15, 2017, paragraphs 127 to 174 and subparagraphs (a) and (b) of paragraph 242, and the judgment of November 24, 2022 in Nombre03 v. Chile. Specifically, in the latter, the Corte IDH expressly states:

“208. Notwithstanding the foregoing, specifically in environmental matters, it should be emphasized that the principle of prevention of environmental harm (principio de prevención de daños ambientales) forms part of customary international law and entails the obligation of States to implement the necessary measures before environmental harm occurs, bearing in mind that, because of its particular characteristics, it will frequently be impossible to restore the pre-existing situation after such harm has occurred. By virtue of the duty of prevention (deber de prevención), the Court has stated that “States are required to use all means at their disposal to prevent activities carried out under their jurisdiction from causing significant harm to the […] environment”200. This obligation must be fulfilled under a standard of due diligence (debida diligencia), which must be appropriate and proportionate to the degree of risk of environmental harm202.

Moreover, although it is not possible to provide a detailed enumeration of all the measures that States might take to fulfill this duty, some measures relating to potentially harmful activities may be identified: i) regulate; ii) supervise and monitor compliance; iii) require and approve environmental impact studies (estudios de impacto ambiental); iv) establish contingency plans; and v) mitigate harm when environmental damage occurs202.” For its part, the in dubio pro natura principle (principio in dubio pro natura), according to the ‘World Declaration of the International Union for Conservation of Nature (IUCN) on the Environmental Rule of Law,’ means that “in cases of doubt, all proceedings before courts, administrative bodies, and other decision-makers shall be resolved in a manner that favors environmental protection and conservation, giving preference to the least harmful alternatives. No action shall be undertaken when its potential adverse effects are disproportionate or excessive in relation to the benefits derived therefrom” (see principle V).

In this regard, according to the document ‘95 Environmental Legal Principles for Ecologically Sustainable Development’ (approved at the XIX Edition of the Ibero-American Judicial Summit‑2018 and by the Corte Plena in Article XIX of session no. 28-2020 of May 25, 2020), “Every person applying environmental rules shall always bear in mind the pro-nature principle (principio pro naturaleza), pursuant to which risks shall be avoided, general collective interests shall take precedence over private interests, environmental preservation shall be favored, and, in cases of doubt, the interpretation affording the broadest protection to the environment shall be preferred.” The in dubio pro natura principle, therefore, does not depend on the existence of a threat of serious or irreversible harm—as is the case with the precautionary principle (principio precautorio)—but instead entails a “general rule of conduct governing the relationship of the State—and society in general—with the environment, applicable to all areas of decision-making in which there is a risk of environmental impact, and requiring us to refrain from choosing courses of conduct that may harm the environment when other options exist” (Olivares and Lucero, 2018).

Furthermore, in judgment no. 2012013367 issued at 11:33 a.m. on September 21, 2012, this Tribunal Constitucional addressed the principles of progressivity and non-regression in environmental matters (principios de progresividad y de no regresión en materia ambiental) as follows:

“V. On the principles of progressivity and non-regression of environmental protection. The principle of progressivity of human rights (principio de progresividad de los derechos humanos) has been recognized by International Human Rights Law; among other international instruments, it is enshrined in Article 2 of the International Covenant on Economic, Social and Cultural Rights, Articles 1 and 26 of the American Convention on Human Rights, and Article 1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights. Pursuant to these provisions, the State assumes the obligation to increase, to the extent permitted by its capabilities and development, the levels of human-rights protection, with particular consideration for rights such as the right to the environment (Article 11 of the Protocol), which require multiple affirmative actions by the State to ensure their protection and full enjoyment by all rights holders.

The principle of non-regression or irreversibility of benefits or protections already attained (principio de no regresividad o de irreversibilidad de los beneficios o protección alcanzada) derives from the principle of progressivity of human rights and the principle prohibiting the retroactive application of rules to the detriment of acquired rights and settled legal situations (principio de irretroactividad de las normas en perjuicio de derechos adquiridos y situaciones jurídicas consolidadas), enshrined in section 34 of the Carta Magna. The principle serves as a substantive guarantee of rights, in this case the right to a healthy and ecologically balanced environment, under which the State is required not to adopt measures or policies, or approve legal rules, that, without reasonable and proportionate justification, worsen the degree to which those rights have been realized. This principle does not entail absolute irreversibility, since all States experience national circumstances of an economic, political, or social nature, or caused by natural events, that negatively affect the achievements attained up to that point and require a downward reassessment of the new level of protection.

In such cases, constitutional law and the principles under examination require any reduction in levels of protection to be justified in light of the constitutional parameters of reasonableness and proportionality. In this regard, the Sala Constitucional has stated in its case law concerning the right to health: ‘…pursuant to the PRINCIPLE OF NON-REGRESSION, measures that diminish the protection of fundamental rights are prohibited. Accordingly, if the Costa Rican State, in order to protect the right to health and the right to life, has adopted a policy of open access to medicines, it cannot—much less through an International Treaty—reduce such access and make it more restrictive under the pretext of protecting trade. (Judgment of the Sala Constitucional No. 9469-07).’ Regarding the right to the environment, it stated: ‘The foregoing constitutes an evolutionary interpretation of environmental protection in accordance with constitutional law, which does not permit regression to its detriment.’ (Judgment of the Sala Constitucional No. 18702-10).” (Emphasis not in the original).

(To the same effect, judgments 2014-012887, 2017-002375, 2017-005994, 2019-012745 and 2019-017397).” Thus, under the principle of progressivity, the State assumes the obligation to increase, insofar as possible, the levels of human-rights protection, including the right to a healthy and ecologically balanced environment. The application of the principle of non-regression, for its part, constitutes a guarantee that compels the State to refrain from adopting measures, policies, or rules that, without reasonable and proportionate justification, worsen the degree of protection already attained for fundamental rights and, where applicable, requires the corresponding compensatory measures to be weighed.

Finally, this Tribunal explained the principle of objective grounding of environmental protection (principio de objetivación de la tutela ambiental) in the following terms:

“As regards the environment, the object of the fundamental right described above, our Carta Magna further requires it to be ‘healthy.’ The requirement that it be ‘healthy’ leads us to ‘regenerative capacity’ and ‘successional capacity’ as means of ensuring life. These two requirements—‘healthy’ and ‘balanced’—give rise to the need for sustainable development; quality of life and environmental quality depend on it. Through the concepts of ‘environment,’ ‘healthy,’ and ‘ecologically balanced,’ the constitutional provision introduced science and technology into environmental decisions, whether legislative or administrative, such that, pursuant to sections 16 of the Ley General de la Administración Pública and 38 of the Ley Orgánica del Ambiente, State actions in environmental matters must be based on, and may not contradict, the unequivocal rules of science and technology, in order to achieve the full and universal enjoyment of a healthy and ecologically balanced environment and, moreover, ‘greater well-being for all inhabitants of the country.’ With respect to subjecting legislative and administrative decisions to the unequivocal rules of science and technology, the Sala has termed this the principle of objective grounding of environmental protection: ‘Objective grounding of environmental protection (…) is a principle that cannot in any way be confused with the preceding one [the precautionary principle or “principle of prudent avoidance”], since, as a consequence of Articles 16 and 160 of the Ley General de la Administración Pública, it entails the need to support decision-making in this area with technical studies, both with respect to acts and to provisions of general application—whether statutory or regulatory—thereby giving rise to the requirement of adherence to science and technology, which constrains the Administration’s discretion in this area.

Accordingly, based on the results of those technical studies—such as environmental impact studies—if objective technical criteria demonstrate the likelihood of evident harm to the environment, natural resources, or human health, the proposed project, works, or activity must be rejected; and where there is “reasonable doubt,” decisions must be made in favor of the environment (pro-nature principle), which may entail the adoption of both compensatory and precautionary measures in order to protect the environment adequately.’ (Judgments of the Sala Constitucional Nos. 21258-10, 17126-06, 14293-05)” (emphasis added). (Decision no. 2012-13367 issued at 11:33 a.m. on September 21, 2012).

VI.The specific case. In the case at bar (sub lite), the petitioner states that several years ago he acquired land in the area adjacent to and bordering Laguna de Carrizal, in the Bajamar sector of Garabito de Puntarenas, which is a recognized wetland (humedal) forming part of the Paso Las Lapas biological corridor (corredor biológico). He alleges that encroachment upon the lagoon’s protected area (zona protegida) began in that area, on a dead-end street terminating at its boundary, where an unauthorized access route was opened and work began to remove the vegetation layer (capa vegetal), as well as the flora and fauna; earthworks (movimientos de tierra) and uncontrolled burning were also carried out. He recounts that in late October 2023 he reported these events to the respondent authorities and not only presented evidence of the encroachment and resulting environmental damage, but also requested that action be taken.

He maintains that since then the encroachment and harmful impacts have increased, as set forth in supplemental filings to the respective complaints. He alleges that he has received no response from the municipality. He adds that Sitada of MINAE, by email dated 22 de enero de 2024, informed him that both the encroachment and the environmental impacts had been verified and that its actions had been limited to filing a complaint with the Garabito Prosecutor’s Office. He states that, in response, he asked why no precautionary action was being taken through administrative proceedings (vía administrativa), such as closing the unauthorized access route opened by the encroachers; however, there has been neither a response nor any enforcement action. He alleges that he has notified the respondent municipality of earthworks and construction within the lagoon’s protected area and has requested information and action concerning applicable regulations, construction, and subdivisions (fraccionamientos); nevertheless, he has received no response.

He explains that the respondent authorities’ inaction has allowed the encroachers to take possession of an increasing portion of the area. He asserts that between el 24 y 26 de enero de 2024, practically all the remaining vegetation layer, flora, and fauna were removed. He requests that the petition be granted and that, as a precautionary measure (medida cautelar), the respondent authorities be ordered to halt the work and block access.

From the review of the record, with respect to SINAC, it is deemed proven that, on 25 octubre de 2023, a complaint was filed through the Environmental Comptroller’s Office of MINAE’s Integrated Environmental Complaint Processing System (Sistema Integrado de Trámite de Denuncias Ambientales, SITADA), in Nombre01 of the protected party, addressed to “Messrs. Sistema Nacional de Áreas de Conservación (SINAC), MINISTERIO DEL AMBIENTE Y ENERGÍA (MINAE), Present; Messrs. Sistema de Área de Conservación Pacífico Central (ACOPAC), Sistema Nacional de Áreas de Conservación (SINAC), MINISTERIO DEL AMBIENTE Y ENERGÍA (MINAE) (…)” with the following content: “(…) I appear for the purpose of Filing this COMPLAINT regarding Highly Possible situations of ‘Impact’ affecting the LAGUNA CARRIZAL WETLAND. And for the purposes of this Filing, I Submit the Following Considerations: PRELIMINARY CLARIFICATION: This Filing Is Addressed to All of Your (Administrative) Authorities, by Virtue of the obligations, Duties, Responsibilities, and Powers that, by Law (in the broad sense), They Have for the purpose of Intervening and Taking Measures of Control, Protection, and Sanction concerning the Significant Environmental Matter Involved in this Complaint.

Accordingly, Each and Every One of the Recipient Agencies before which this Filing is made is Obligated to Act (Arts. 11, 27, 30, 41, 50 and 129 of the Political Constitution). REGARDING THE WETLAND IN QUESTION: From what we have Been Able to Verify, LAGUNA DE CARRIZAL is indeed a Recognized Wetland (humedal), which Forms Part of Corredor Biológico Paso las lapas. It Is Located in the District of Tárcoles, Canton of Garabito, Province of Puntarenas. BARRANCA Topographic Map Sheet. Latitude: 9º 50´13” and Longitude 64º 40’ 40”. (…) REGARDING THE BASIS OF MY COMPLAINT: As I have already stated, although I am a Merchant in San José, for Several Years I Have Been the Lawful Owner/Usufructuary of a Parcel of Land in the Carrizal Area. Its Western Boundary Adjoins the Laguna de Carrizal Area. Access to my Property is by what was a Dead-End Street, which ENDS AT THE AFOREMENTIONED WETLAND, WITHOUT PROVIDING ANY ACCESS TO IT.

(…) First, several Weeks ago, a Group of Persons whose identity I Do Not Know Came and Constructed an ACCESS GATE TO THE WETLAND AREA AT THE END OF THE AFOREMENTIONED DEAD-END STREET. Subsequently, these same Persons Began Carrying Out Burns in the Wetland Area. I DO NOT KNOW HOW THESE AFFECT THIS PROTECTED AREA. And a Few Days ago, the Gentlemen in question Contacted me to Offer to SELL me and/or Develop the Area Behind or to the Rear of my Property, which I Have Identified as Part of the Laguna Carrizal Wetland. Such Facts Evidently Indicate Occupation and Potential Urban Development in the Aforementioned Wetland Area. And This is what Leads me to Apply to your Authorities, as Necessary and/or Potential Participants in connection with Any Situation Related to the aforementioned Protected Area (zona protegida). (…) REQUEST FOR PROCESSING, INVESTIGATION, AND INFORMATION: 1. In view of what is Reported and Complained of herein to All of your Authorities, THEY ARE HEREBY PLACED ON NOTICE, for All Legal and Applicable Purposes, including their Responsibilities for Omission or Failure to Perform their Functions, Powers, and Duties (Potential Gross Fault and/or Negligence).

This shall apply if the Potential Encroachment upon and/or Impact on the Wetland that is the Subject of this Complaint is Permitted or Tolerated through Omission. 2- With respect to the MINAE Authorities to which this Complaint is Submitted, All investigative, Control, Safeguarding, and Sanctioning Actions are Requested concerning the matters Complained of and the Effective Protection of the wetland that is the Subject of this Complaint. It is also requested that the Opening of Improper Access (Gate) to the aforementioned Wetland be investigated and acted upon. (…) AND WITH RESPECT TO ALL RECIPIENTS OF THIS COMPLAINT, THE UNDERSIGNED BECOMES A DIRECTLY INTERESTED PARTY AND REQUESTS THAT WE BE PROVIDED WITH A RESPONSE AND INFORMATION REGARDING THE ACTIONS TAKEN BY THOSE AGENCIES WITHIN THE TIME LIMITS PRESCRIBED BY LAW. I AWAIT A PROPER AND EFFECTIVE RESPONSE (ARTS. 27, 30 AND 41 OF THE POLITICAL CONSTITUTION).

NOTICES: I Will Receive Them at the Email Address of my Attorney, Lic. Mario Quesada Aguirre. [...]. San José, 24 de Octubre del 2023” (sic). The complainant’s grievance entered in SITADA was assigned registration no. 43570-2023. ACOPAC, through the visual inspection record (acta de inspección ocular) issued at 8:41 hours on 22 de noviembre de 2023, recorded: “An inspection is conducted to address a complaint entered in SITADA concerning encroachment upon the protection area (área de protección) of Laguna Carrizal; the complaint mentions the installation of an access gate to the Laguna. During this inspection, the allegations are confirmed, coordinates and measurements are taken, as well as photographs; additionally, a road constructed parallel to the Laguna, presumably using machinery, is found. The structures found within the Laguna’s protection area consist of a black wooden and metal gate measuring 5 meters wide by 1.40 m high, a cement and ceramic wall beside the gate measuring 2.28 m wide by 1.61 m high, and a barbed-wire fence 9 m wide running perpendicular to the shore of the Laguna.

The road located beside the gate and running eastward measures 60 m long by 4.30 m wide. That is all.” On 22 de enero de 2024, the person in charge of the Prevention, Protection, and Control Program of the Wildlife Program Liaison Office at SINAC’s ACOPAC Orotina Subregional Office informed the email address [...] as follows: “I hereby inform you that the complaint entered in SITADA under registration number 43570-2023 was addressed (see the visual inspection record entered on the platform), and the report was submitted to the Fiscalía de Garabito on jueves 18 de enero de 2024 under report number SINAC-ACOPAC-OSRO-PPC-223-2023. We do not have the judicial case file number because the Fiscalía de Garabito does not provide it to us when the report is submitted. I also consider it important to mention that a complaint regarding the matter in question was filed with the same Fiscalía in 2021 in response to SITADA complaint 25424-2021, through report SINAC-ACOPAC-DRFVS-055-2021, signed by official Gil Ruiz, judicial case file [Valor 006].

In addition, in 2022, police report SINAC-ACOPAC-OSRO-551-2022, signed by me, was submitted as a supplement to judicial case file [Valor 002]. Likewise, in that same year, official Adrian (sic) Arce signed report SINAC-ACOPAC-PINV-005-2022. All the reports concern impacts caused by burns both in the vicinity of Laguna Carrizal and in sectors that were in Nombre01 of Asociación de vecinos de Bajamar. Finally, I inform you that the status of that proceeding or those proceedings is currently unknown.” The person in charge of the Prevention, Protection, and Control Program at the Orotina Subregional Office of Área de Conservación Pacífico Central stated in official letter (oficio) SINAC-ACOPAC-OSRO-PPC-020-2024 of 1º de febrero de 2024: “The complaint was addressed on 22 de noviembre de 2023, and the visual inspection record was entered into the SITADA platform that same day; the report was subsequently submitted to the Fiscalía de Garabito on jueves 18 de enero de 2024 under report number SINAC-ACOPAC-OSRO-PPC-223-2023.

To date, the judicial case file number is unavailable because the Fiscalia (sic) de Garabito does not provide it to us when the report is submitted; consequently, the report has not been attached to the platform for follow-up by the Legal Counsel’s Office. In addition to the present complaint concerning Laguna Carrizal, other complaints have been addressed, and a complaint was filed with the same Fiscalia (sic) in 2021 in response to SITADA complaint 25424-2021, through report SINAC-ACOPAC-DRFVS-055-2021, signed by official Gil Ruiz, judicial case file [Valor 007]. In addition, in 2022, police report SINAC-ACOPAC-OSRO-551-2022, signed by me, was submitted as a supplement to judicial case file [Valor 002]. Likewise, in 2021, official Adrian (sic) Arce signed report SINAC-ACOPAC-PINV-005-2022. All the reports concern impacts caused by burns both in the vicinity of Laguna Carrizal and in sectors that were in Nombre01 of Asociación de vecinos de Bajamar.

On the other hand, it is important to mention that, although Laguna Carrizal is located in an area adjacent to the coast, it lies within privately owned property recorded under registration number a mbre01 d de ASOCIACION (sic) DE LA COMUNIDAD DE BAJAMAR CEDULA (sic) JURIDICA (sic) 3-002-320413. Additionally, regarding the reported facts, no evidence or information from witnesses has been obtained that would make it possible to identify the accused person or persons.” Official letter SINAC-ACOPAC-OSRO-PPC-223-2023 of 29 de diciembre de 2023, addressed to the Fiscalía de Garabito, states: “SUBJECT: Report concerning environmental damage. Dear Sirs: I, the undersigned, Stephanie Paola Alvarado Ledezma (…) an Official of the Sistema Nacional de Áreas de Conservación of the Ministerio de Ambiente y Energía, acting in the capacity of a police authority (autoridad de policía), pursuant to Article 54 of the Ley Forestal and Article 16 of the Ley de Vida Silvestre, assigned pursuant to case law to the Oficinal Sub Regional de Orotina, appear before your authority for the purpose of reporting the following acts against Natural Resources, as detailed below: 1.

FACTS FIRST: Through the Integrated Environmental Complaint Processing System (SITADA), a complaint was received containing an attached written submission that mentions impacts on the Laguna Carrizal wetland, located in Bajamar, Tárcoles, Garabito. SECOND: Accordingly, on 22 de noviembre de 2023 at 08:40 hours, the complaint was addressed in the company of officials from the Environmental Unit of the Servicio Nacional de Guardacostas at Estación de Caldera. THIRD: At the site, located on the northern side of Laguna Carrizal, a black wooden and metal gate measuring 5 meters wide by 1.40 m high was found; beside the gate is a cement and ceramic wall measuring 2.28 m wide by 1.61 m high. FOURTH: A barbed-wire fence 9 m long, running perpendicular to the shore of the Laguna, was also found. FIFTH: The opening of a road, apparently constructed using machinery, was also found. It begins beside the gate described above, runs parallel to the shore of the Laguna, and measures 60 m long by 4.30 wide.

SIXTH: What was found during this inspection lies within the protection area of Laguna Carrizal (50 m), as can be seen in Figure 1. SEVENTH (sic): According to the verification of coordinates using the Quantum GIS program and the information contained in the property information layers of the SNIT (Sistema Nacional de Información Territorial) Real Property Registry (Registro Inmobiliario) of the Registro Nacional, the property where the road was constructed is recorded under property number Dirección01 a mbre01 d de [Nombre 003], identity card [CED02], [Nombre 004], identity card [CED03], [Nombre 005], identity card [Valor 010], [mbre01 0 006] (sic), identity card [Valor 011]. EIGHTH: Furthermore, the gate is located in an area where a public road ends, according to the public-road information layer. NINTH: This inspection detected not only what Mr. [mbre01 0 001] reported, but also that the property adjoining the reported works has a cement perimeter wall, 96 m of which lies within the protection area of Laguna Carrizal, and that there are also two buildings within the protection area.

The foregoing could be observed by reviewing the coordinates and using the Google Satellite image, since it could not be clearly observed in the field because the property was closed off. TENTH (sic): The perimeter wall, as well as the two buildings, are located on the property with land-registry folio number , a re01 de de [re01 007 007] (sic) Identity Card (Cedula) [Valor 6], [], [re01 008 008] Identity Card (Cedula) [Valor 7]”. ]”.

On the other hand, with respect to the Municipalidad de Garabito, it was established that, in October 2023, it received a complaint under Nombre01 of the protected party addressed to “Mr. Municipal Mayor and Members of the Municipal Counsel (sic) MUNICIPALIDAD DE GARABITO Present Messrs. Technical Services and Environmental Services Units MUNICIPALIDAD DE GARABITO (…)” with the following content: “(…) I appear for the purpose of filing this COMPLAINT regarding highly possible situations of ‘Impact’ on the CARRIZAL LAGOON WETLAND. For the purposes of this submission, I set forth the following considerations: PRELIMINARY CLARIFICATION: This submission is addressed to all your (Administrative) Authorities, by virtue of the obligations, Duties, Responsibilities, and Powers vested in them by Law (in the broad sense), for the purpose of Intervening and Taking Control, Protection, and Enforcement Actions regarding the Significant Environmental Matter involved in this Complaint.

Accordingly, based on the merits thereof, Each and Every one of the Recipient Offices before which this submission is made has an Obligation to Act (Arts. 11, 27, 30, 41, 50 and 129 of the Political Constitution). Such Events Clearly Indicate Occupation and Potential Urban Development in the Aforementioned Wetland Area. And This is what Leads me to Apply to your Authorities, as Necessary and/or Potential Participants, concerning Any Situation Related to the aforementioned Protected Area. (…) REQUEST FOR PROCESSING, INVESTIGATION, AND INFORMATION: 1. Given what is Reported and Complained of herein to All your Authorities, YOU ARE HEREBY PLACED ON NOTICE thereof for All Legal and Proper Purposes, taking into account your Responsibilities for Omission or Failure to Fulfill your Functions, Powers, and Duties (Potential Gross Negligence and/or Negligence).

This applies if the Potential Encroachment upon and/or Impact on the Wetland that is the Subject of this Complaint is Permitted or Tolerated by Omission. (…) 3.- The Authorities of the Municipalidad de Garabito to whom this Complaint is Submitted are also Required to undertake All Investigation, Control, and Enforcement Actions concerning the matters Complained of and the Effective Protection of the Wetland that is the Subject of this Complaint. They are also hereby warned NOT TO GRANT Any Permit for Lot Creation, subdivision (fraccionamiento), Construction, and/or Urban Development in the Identified and Clearly Located Wetland Area. They must also Investigate and Take Action regarding the Opening of an Unauthorized Access Point (Gate) to the aforementioned Wetland. WITH RESPECT TO ALL RECIPIENTS OF THIS COMPLAINT, THE UNDERSIGNED HEREBY BECOMES A DIRECTLY INTERESTED PARTY AND REQUESTS THAT WE BE PROVIDED WITH A RESPONSE AND INFORMATION REGARDING THE ACTIONS TAKEN BY THOSE OFFICES WITHIN THE TIME LIMITS ESTABLISHED BY LAW.

I AWAIT A PROPER AND EFFECTIVE RESPONSE (ARTS. 27, 30 AND 41 OF THE POLITICAL CONSTITUTION). NOTICES: I will receive them at the Email Address of my Attorney, Lic. Mario Quesada Aguirre. [...]. San José, 24 de Octubre del 2023”. By official letter SAM-477-2023 of 31 de octubre de 2023 addressed to “Tobías Murillo Rodríguez Municipal Mayor Municipalidad de Garabito,” the acting coordinator and the acting senior process analyst, both from Environmental and Municipal Services of the Municipalidad de Garabito, stated: “With respect to the request made through Official Letter AMI-2237-2023-TM concerning miscellaneous-document forms 41648-41647: ‘I am forwarding to you a copy of miscellaneous-document forms 41648-41647, signed by Mr. [Nombre01 002] (sic) [Nombre01 001], who submits a formal complaint regarding impact on the laguna Carriza wetland, so that, within 10 business days, you may prepare a report on the matter and notify the administered party.’ Based on the foregoing, you are informed that the complaint was entered into the Integrated Environmental Complaints Processing System (Sistema Integrado de Trámite de Denuncias Ambientales, SITADA), administered by the Contraloría Ambiental, in which the Municipalidad de Garabito has a user account.

It should be noted that the complaint is identified by code 43570-2023 and was assigned by the Contraloría Ambiental to the Sistema Nacional de Áreas de Conservación del Área de Conservación Pacífico Central (SINAC-ACOPAC), because it is the MINAE office vested with authority to address complaints relating to wetlands. This is because it has experts in the field, unlike the Municipalidad de Garabito. Therefore, SINAC will proceed to conduct the corresponding investigation and, as required, the Department of Environmental and Municipal Services will provide the necessary support within the scope of its authority to address the case (…)”. By official letter SAM-046-2024 of 6 de febrero de 2024 addressed to “Ladies and Gentlemen, Legal Management Municipalidad de Garabito,” the acting coordinator and the acting senior process analyst, both from Environmental and Municipal Services of the Municipalidad de Garabito, explained: “This is to inform you of the actions taken by the Department of Environmental and Municipal Services in relation to the complaint filed by Mr. [Nombre01 001]: • On 31 de octubre del 2023, through official letter SAM-477-2023, a response was sent to the request submitted in official letter AMI-2297-2023›TM at email address ...01.

It informed him that the complaint had been entered into the Integrated System for the Processing and Handling of Environmental Complaints (Sistema Integrado de Trámite y Atención de Denuncias Ambientales, SITADA) and assigned to the Sistema Nacional de Áreas de Conservación (SINAC) for handling. • On 29 de enero del 2024, a response was sent from email addresses ...02 and ...03 to one of the emails received from the address [...]. It requested a telephone number through which contact could be made in order to provide the appropriate assistance within the scope of our authority. • On 6 de febrero del 2024, an inspection was conducted at the identified site together with Lic. Jason Angulo of the Department of Technical Services – Zona Marítima Terrestre and inspector Vanessa Camacho of the Department of Security and Social Coexistence. The property apparently corresponds to parcel 0045251, private property that was not entered because no one was present at the site to allow us access.

Nevertheless, the existence of any municipal permits issued was verified, and none exist. The records also contain Closure Report 0079-2021, drawn up in 2021. (…) Official Letter SAM-477-2023 and proof of the emails sent in response are attached.” Against this background, the appeal must be granted, based on the following considerations.

First, the Chamber observes that the request submitted to SINAC describes the impact on the “laguna Carrizal wetland” caused by the erection of structures and the carrying out of burns; it also requests an investigation into the matters raised and the implementation of control, safeguarding, and enforcement measures. However, that decentralized body of MINAE merely conducted an inspection in the area and filed a criminal complaint with the Ministerio Público (which did not address all the issues alleged in the appellant’s submission). It should be noted that the “Report on environmental damage” sent to the prosecutor’s office referred only to construction and the opening of a road within the protection area (área de protección) of laguna Carrizal. In any event, once a potentially environmentally significant situation has been identified, SINAC’s action at the administrative level cannot be limited to referring the matter to the investigative stage of criminal proceedings.

That office is specifically empowered to institute proceedings concerning complaints filed for violations of environmental regulations and to issue administrative acts (actos administrativos) to secure compliance with them. Consequently, the failure to address the substance of the reported situation is constitutionally significant for purposes of ensuring the protection afforded by Article 50 of the Constitution.

In relation to the foregoing, the Ley de Biodiversidad provides:

“ARTICLE 22 Sistema Nacional de Áreas de Conservación. The Sistema Nacional de Áreas de Conservación, hereinafter referred to as the System, is hereby created and shall have its own legal personality; it shall be a decentralized and participatory institutional management and coordination system that integrates powers relating to forestry, wildlife, protected areas, and the Ministerio del Ambiente y Energía, for the purpose of establishing policies and planning and implementing processes aimed at achieving sustainability in the management of Costa Rica’s natural resources. In accordance with the foregoing, the Dirección General de Vida Silvestre, the Administración Forestal del Estado, and the Servicio de Parques Nacionales shall exercise their functions and powers as a single body through the System’s administrative structure, without prejudice to the objectives for which they were established. The System’s authority shall include the protection and conservation of the use of watersheds and water systems.

(…)

ARTICLE 28.- Conservation Areas. The System shall consist of territorial units known as Conservation Areas (Áreas de Conservación), under the general supervision of the Ministerio del Ambiente y Energía through the Consejo Nacional de Áreas de Conservación, with authority throughout the national territory, whether involving protected wilderness areas, highly fragile areas, or privately owned areas used for economic exploitation. Each Conservation Area is a territorial unit of the country, administratively delimited, governed by a single development and management strategy, and duly coordinated with the rest of the public sector. Within each one, private and state conservation activities are interrelated without detriment to protected areas. The Conservation Areas shall be responsible for enforcing current natural-resource legislation within their geographical boundaries. They shall implement the policies, strategies, and programs approved by the Consejo Nacional de Áreas de Conservación concerning protected areas; they shall also be responsible for enforcing other laws governing their subject matter, such as the Ley de conservación de la vida silvestre, No. 7317, de 30 de octubre de 1992, the Ley Forestal, No. 7575, de 13 de febrero de 1996, the Ley Orgánica, No. 7554, de 4 de octubre de 1995, and the Ley de Creación del Servicio de Parques Nacionales, No. 6084, de 24 de agosto de 1977.

Based on the Council’s recommendations, the Ministerio del Ambiente y Energía shall define the technically most appropriate territorial division for the country’s Conservation Areas, as well as any modifications thereto.” Likewise, the Ley de Conservación de Vida Silvestre provides:

“Article 7.- The Sistema Nacional de Áreas de Conservación of the Ministerio de Ambiente y Energía shall have the following functions in the exercise of its authority:

  • a)Establish the technical measures to be followed for the proper management, conservation, and administration of wildlife (vida silvestre)(*), which is the subject matter of this law and of the respective international conventions and treaties ratified by Costa Rica.

(*)(Its designation was amended by article 3° of law N° 9106 of 20 de diciembre del 2012; it previously read "flora y fauna silvestre")

  • b)Establish and administer national wildlife refuges (refugios nacionales de vida silvestre).
  • c)Promote the establishment of national wildlife refuges on mixed-ownership or private property.
  • d)Promote and implement education and research programs concerning the additional use of the country’s renewable natural resources in the field of wildlife within its authority, in accordance with this law.
  • e)Promote and conduct research in the field of wildlife, except research concerning genetic and biochemical resources governed by the Ley de Biodiversidad.
  • f)Issue, deny, or revoke permits for control hunting, extraction, research, and scientific and academic collection, and any permit to import or export wildlife, its parts, products, and derivatives; and approve, reject, or modify the management plans (planes de manejo) and operating permits (permisos de funcionamiento) of the various wildlife-management facilities, wildlife refuges, and wildlife-management activities that require them.
  • g)Finance theses or research that contribute to better knowledge of wildlife.
  • h)Protect, oversee, and administer wetlands (humedales) using an ecosystem-based approach, and determine whether they qualify as being of national or international importance.
  • i)Create and manage wildlife management, control, monitoring, and research programs.
  • j)Support the formal and informal education programs of the Comisión Interinstitucional para la Educación y la Conciencia Pública e Investigación en Biodiversidad (Ciecopi).
  • k)Coordinate with the other competent entities in preventing, mitigating, addressing, and monitoring harm to wildlife.
  • l)Promote the responsible participation of persons, individually or collectively, in preserving and restoring ecological balance and protecting the environment.
  • m)Promote the conservation of natural ecosystems.
  • n)Establish contingency plans for the protection of wildlife in the event of natural disasters.
  • ñ)Coordinate actions with public or private, national or international institutions for the conservation and sustainable management of wildlife.

Wetland boundaries shall be established by executive decree, in accordance with technical criteria.

(As amended by article 1 of law N° 9106 of 20 de diciembre de 2012)”.

In addition, section 99 of the Ley Orgánica del Ambiente provides:

“Article 99.- Administrative penalties (sanciones administrativas). In the event of a violation of environmental-protection regulations or conduct harmful to the environment that is clearly established in this law, the Public Administration shall impose the following protective measures and penalties:

  • a)A warning, through notification that a complaint has been filed.
  • b)A reprimand proportionate to the seriousness of the violations, once they have been substantiated.
  • c)Enforcement of the performance bond (garantía de cumplimiento) furnished during the environmental impact assessment (evaluación de impacto ambiental).
  • d)Partial or total restrictions, or an order immediately halting the acts giving rise to the complaint.
  • e)Total or partial, temporary or permanent closure of the activities or circumstances giving rise to the complaint.
  • f)Partial or total, permanent or temporary revocation of the permits, licenses, premises, or businesses giving rise to the complaint or to the polluting or destructive act or circumstance.
  • g)Imposition of obligations to compensate for or stabilize the environment or biological diversity.
  • h)Modification or demolition of buildings or works that harm the environment.
  • i)Alternatives for satisfying the penalty, such as attending official environmental-education courses and performing community work in the environmental field.

These penalties may be imposed on private persons or public officials for actions or omissions that violate the provisions of this law or other provisions protecting the environment or biological diversity.” Consequently, the petition must be granted as to SINAC, so that, irrespective of referring the matter for criminal proceedings, it may fully examine the reported situation through administrative proceedings (vía administrativa) in light of the legal system, resolve all the issues raised, and, if appropriate, issue the corresponding administrative acts (actos administrativos).

Furthermore, the Municipalidad de Garabito also received the complainant’s report requesting intervention by the local government within the scope of its authority, for example, among other matters, with respect to municipal permits and the impact of the works on the aforementioned wetland. However, there is no evidence that, after more than two months, the reported situation had been addressed or any response had been served. This is particularly significant because, according to the case record, the inspection conducted by the municipal authorities confirmed that no municipal permits existed. Therefore, because the environment may be affected, the petition must also be granted against the respondent municipality.

VII.Dissenting opinion (voto salvado) of Justice Salazar Alvarado. With due respect, I dissent from the majority opinion granting the petition, for the following reasons:

The right to a healthy and ecologically balanced environment is protected under the Costa Rican legal system not only by article 50 of the Constitución Política, but also by a series of laws and executive decrees (regulations) currently in force, such as the Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; the Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; the Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; and Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), to name only a few. This makes it necessary, in environmental matters, to distinguish constitutional review (control de constitucionalidad) from legality review (control de legalidad). In this regard, it is the undersigned’s view that, in amparo proceedings (vía de amparo), this Chamber should hear a matter alleging violation of the right to a healthy and ecologically balanced environment only if the Administration has not yet intervened and the violation of that right is manifest and evident, readily ascertainable, of some importance or seriousness, and directly affects a particular person or community.

Otherwise, the matter must be raised and adjudicated in legality proceedings (vía de legalidad). Accordingly, mere noncompliance with obligations and duties legally imposed on the various public administrations in environmental matters is properly heard in legality proceedings—whether administrative or judicial—where the alleged instances of noncompliance or omission may be reviewed much more thoroughly. It must be borne in mind that an amparo petition (recurso de amparo) is a summary, informal, simple, and expeditious proceeding. Thus, from the very moment the Administration intervenes in an environmental matter in the exercise of its authority and conducts a proceeding culminating in administrative acts, review of that matter falls outside the scope of this specialized jurisdiction. Therefore, review of administrative actions taken with respect to an environmental matter that, for their proper assessment, require full adjudicatory proceedings (proceso de conocimiento pleno) is possible only in the ordinary courts, because the design of amparo proceedings is incompatible with comparing or reviewing technical or legal criteria developed pursuant to the laws or regulations in force, or with receiving additional and more extensive evidence needed to compare or review the criteria already contained in the administrative record for the case.

Holding otherwise would transform amparo into ordinary full adjudicatory proceedings, thereby distorting its nature and frustrating the purposes for which it was designed, and causing it to lose its status as an instrument for the effective protection of fundamental rights. Consequently, I find that when a public entity or body has intervened in various ways, or has issued administrative acts concerning an environmental matter, its review and oversight fall within the jurisdiction of the administrative courts (jurisdicción de lo contencioso-administrativo). It is precisely the verification that such administrative intervention exists that determines that the matter belongs in legality proceedings. Consequently, this petition should have been summarily dismissed because its subject matter is properly discussed, analyzed, and resolved in legality proceedings. However, because it was not, the proper course is to deny the petition without ruling on the merits of the issue presented, since it is for the ordinary courts—specifically, the administrative courts—to determine whether the challenged administrative actions and conduct substantively comply with the provisions of the legal system having the force of law regarding the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment.

VIII.Documents submitted to the case record. This Chamber must warn the petitioner that, if the petitioner submitted any document, whether on paper, as well as any objects or evidence stored on any additional device or on electronic, digital, magnetic, optical, or telematic media, or produced using new technologies, such items must be retrieved from the court’s offices within 30 business days after notice of this judgment is received. Otherwise, all such items shall be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, approved by the Corte Plena at session N° 27-11 of 22 de agosto de 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo de 2012, article LXXXI.

Therefore:

The amparo appeal is granted. It is ordered: 1) David Chavarría Morales and Jeffrey Hernández Espinoza, respectively acting executive director and regional director of the Área de Conservación Pacífico Central, both of the Sistema Nacional de Áreas de Conservación, or whoever holds those positions, shall coordinate the necessary measures, issue the pertinent orders, and carry out all actions within the scope of their authority so that, within a maximum period of ONE MONTH from notification of this judgment, the situation reported by the petitioner in the submission dated 25 de octubre de 2023 is fully analyzed, all claims raised are resolved, and, if appropriate, the administrative acts falling within the authority of the Sistema Nacional de Área de Conservación are issued; all of which shall be notified to the appellant through the means designated for such purpose within the same period granted ut supra. 2) Tobías Murillo Rodríguez, mayor of Garabito, or whoever holds that position, as well as whoever serves as president of the Concejo Municipal and the official in charge of Gestión Ambiental, both of the Municipalidad de Garabito, shall coordinate the necessary measures, issue the pertinent orders, and carry out all actions within the scope of their authority so that, within a maximum period of ONE MONTH from notification of this judgment, the situation reported by the petitioner in the submission of octubre de 2023 is fully analyzed, all claims raised are resolved, and, if appropriate, the administrative acts falling within the authority of that local government are issued; all of which shall be notified to the appellant through the means designated for such purpose within the same period granted ut supra.

The respondent authorities are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo) that they are required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State and the Municipalidad de Garabito are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) in contentious-administrative proceedings (contencioso administrativo). Justice Salazar Alvarado dissents and would deny the appeal, because it falls to the ordinary jurisdiction (jurisdicción ordinaria), specifically the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa), to determine whether the challenged administrative actions and conduct substantively comply with the provisions of the statutory legal framework concerning the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment. Let notice be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veintitres de febrero de dos mil veinticuatro .

Recurso de amparo que se tramita en el expediente nro. 24-002313- 0007-CO, interpuesto por [Nombre01 001], cédula de identidad [Valor CED04], contra el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (Sinac) y la MUNICIPALIDAD DE GARABITO.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala el 29 de enero de 2024, la parte recurrente plantea recurso de amparo contra el Ministerio de Ambiente y Energía (Minae), el Sinac y la Municipalidad de Garabito. Indica que hace unos años adquirió un terreno en la zona aledaña y limítrofe con la Laguna de Carrizal, en el sector de Bajamar, en Garabito de Puntarenas, la cual es un humedal reconocido que forma parte del corredor biológico Paso Las Lapas. Explica que, en setiembre y octubre de 2023, unas personas le propusieron vender un terreno colindante con la parte trasera de su inmueble, el cual se ubica en la zona pública protegida de la Laguna de Carrizal; sin embargo, declinó participar del negocio. Aduce que posteriormente se iniciaron acciones de invasión a la zona protegida de la laguna en una calle sin salida que termina en el límite de esta, abrieron un acceso no autorizado y comenzaron con labores de eliminación tanto de la capa vegetal como de la flora y fauna; además realizaron movimientos de tierra y quemas no controladas.Relata que a finales de octubre de 2023 denunció lo acontecido ante las autoridades recurridas, además no solo evidenció la invasión y los daños ambientales producidos, sino que también solicitó que se ejecuten acciones al respecto. Sostiene que desde ese momento las acciones de invasión y afectaciones han sido mayores, lo cual ha sido ampliado en las respectivas denuncias. Acusa que no ha obtenido respuesta de la municipalidad recurrida. Acota que el SITADA del Minae, mediante correo electrónico de 22 de enero de 2024, le comunicó que habían constatado las invasiones y afectaciones ambientales; empero, se limitaron a formular la denuncia ante la fiscalía de Garabito. Refiere que ante esa respuesta solicitó que le indicaran por qué no tomaban alguna acción cautelar en vía administrativa, tal como eliminar el acceso indebido abierto por los invasores; sin embargo, no ha habido respuesta ni acciones de control.Alega que ha advertido ante la municipalidad recurrida labores de movimientos de tierras y de construcción en el área protegida de la laguna, así como ha pedido información y acciones desde la perspectiva de las normas, construcciones y fraccionamientos; no obstante, tampoco le han contestado. Explica que la inacción de las autoridades recurridas ha permitido que los invasores se adueñen más de la zona. Asevera que entre el 24 y 26 de enero de 2024 se eliminó prácticamente tanto la capa vegetal como la flora y fauna que quedaba. Pide que se declare con lugar el recurso y que, como medida cautelar, se ordene a las autoridades accionadas detener las obras y bloquear el acceso.
  2. 2Mediante resolución de las 17:46 horas de 30 de enero de 2024, la Presidencia de la Sala dio curso al proceso contra el Sinac y la Municipalidad de Garabito. En adición, solicitó informe al alcalde, presidente del concejo y encargado de Gestión Ambiental, todos del gobierno local recurrido; así como al jefe del Área de Conservación Pacífico Central (Acopac) y al director ejecutivo del Sinac.
  3. 3Por escrito incorporado al expediente digital el 6 de febrero de 2024, rinde informe bajo juramento Jeffrey Hernández Espinoza, director regional del Área de Conservación Pacífico Central del Sistema Nacional de Áreas de Conservación, en estos términos: “En atención a los alegatos expuestos por el recurrente, se detallan las actuaciones realizadas por el Área de Conservación Pacífico Central, consignadas mediante informe técnico SINAC-ACOPACOSRO-PPC-020-2024, suscrito por la funcionaria Paola Alvarado Lezama, encargada del programa de Prevención, Protección y Control, Vida Silvestre de la oficina Subregional de Orotina y remitido por el Jefe Subregional de Orotina mediante oficio ACOPAC-OSRO-054-2024, el cual se expone a continuación: Por este medio le informo sobre las actuaciones realizadas con relación a la queja ingresada en el Sistema Integrado de Tramite de Denuncias Ambientales con el número de registro SITADA 43570-2023.La queja fue atendida el día 22 de noviembre de 2023, cuya acta de inspección ocular se ingresó en la plataforma SITADA el mismo día, posteriormente el informe fue presentado en la Fiscalía de Garabito el día jueves 18 de enero de 2024 con el número de informe SINAC-ACOPAC-OSRO-PPC-223-2023. A la fecha no se cuenta con el número de expediente judicial pues la Fiscalía de Garabito no nos da el numero en el momento que se entrega el mismo, y en consecuencia no se ha adjuntado dicho informe para seguimiento de la Asesoría Legal en la plataforma. Sobre el caso de la Laguna Carrizal además de la presente queja, se han atendido otras quejas siendo que se presentó una denuncia en la misma Fiscalía en el año 2021 en atención a la queja SITADA 25424-2021 por medio del informe SINAC-ACOPAC-DRFVS055-2021 suscrito por el funcionario Gil Ruiz expediente judicial [Valor 002]. Además, en el año 2022 se presentó el informe policial SINAC-ACOPAC-OSRO-551-2022 suscrito por mi persona como ampliación al expediente judicial [Valor 002].Así mismo en el año 2021 el funcionario Adrian Arce suscribió el informe SINAC-ACOPAC-PINV-005-2022. Todos los informes son relacionados con afectaciones realizadas por quemas tanto en los alrededores de la Laguna Carrizal como en sectores que se encontraban a Nombre01 de la Asociación de vecinos de Bajamar. Por otro lado, es importante mencionar que, si bien la Laguna Carrizal se encuentra en un área aledaña a la costa, la misma se encuentra dentro de propiedad privada inscrita con el número de matrícula a mbre01 d de ASOCIACION DE LA COMUNIDAD DE BAJAMAR CEDULA JURIDICA CED01. Adicionalmente sobre los hechos denunciados no se ha tenido indicios o información de testigos para poder identificar a la persona o personas imputadas. Como se puede ver del informe remitido de la oficina Subregional que atendió el caso se cumplió a cabalidad con la atención de la denuncia interpuesta en acatamiento de lo indicado en el Oficio Circular SINAC-SE-DE-356-2023, en el que se indica las actividades a realizar por parte del personal de control y protección del SINAC.Aunado a ello la denuncia interpuesta se le asigno el número de expediente judicial [Valor 003], conforme consulta realizada por la Asesoría legal del ACOPAC ante la Fiscalía de Garabito. Sobre lo indicado por el recurrente sobre la toma acciones administrativas de manera cautelar para eliminar el acceso indebido abierto por los invasores, es una acción que se encuentra fuera del marco de las competencias del SINAC siendo ésta del Municipio. Petitoria Se declare sin lugar el presente recurso de amparo por cuanto tal como se prueba, la Oficina Subregional del ACOPAC ha realizado las acciones que por normativa corresponde para la atención de la situación interponiendo la respectiva denuncia ambiental ante la Fiscalía de Garabito e igualmente se ha informado sobre las acciones que ha realizado la administración en el sector conforme la prueba aportada”.
  4. 4Por escrito incorporado al expediente digital el 8 de febrero de 2024, rinde informe bajo juramento David Chavarría Morales, director ejecutivo a.i. del Sinac. Expone lo siguiente: “SEGUNDO: Que en informe técnico SINAC-ACOPAC-OSRO-PPC020-2024, suscrito por la funcionaria Paola Alvarado Lezama, encargada del programa de Prevención, Protección y Control, Vida Silvestre de la oficina Subregional de Orotina señala lo siguiente: “Por este medio le informo sobre las actuaciones realizadas con relación a la queja ingresada en el Sistema Integrado de Tramite de Denuncias Ambientales con el número de registro SITADA 43570-2023. La queja fue atendida el día 22 de noviembre de 2023, cuya acta de inspección ocular se ingresó en la plataforma SITADA el mismo día, posteriormente el informe fue presentado en la Fiscalía de Garabito el día jueves 18 de enero de 2024 con el número de informe SINAC-ACOPACOSRO-PPC-223-2023.A la fecha no se cuenta con el número de expediente judicial pues la Fiscalía de Garabito no nos da el numero en el momento que se entrega el mismo, y en consecuencia no se ha adjuntado dicho informe para seguimiento de la Asesoría Legal en la plataforma. Sobre el caso de la Laguna Carrizal además de la presente queja, se han atendido otras quejas siendo que se presentó una denuncia en la misma Fiscalía en el año 2021 en atención a la queja SITADA 25424-2021 por medio del informe SINAC-ACOPAC-DRFVS-055-2021 suscrito por el funcionario Gil Ruiz expediente judicial [Valor 004]. Además, en el año 2022 se presentó el informe policial SINAC-ACOPAC-OSRO-551-2022 suscrito por mi persona como ampliación al expediente judicial [Valor 005]. Así mismo en el año 2021 el funcionario Adrian (sic) Arce suscribió el informe SINAC-ACOPAC-PINV-005-2022. Todos los informes son relacionados con afectaciones realizadas por quemas tanto en los alrededores de la Laguna Carrizal como en sectores que se encontraban a Nombre01 de la Asociación de vecinos de Bajamar.Por otro lado, es importante mencionar que, si bien la Laguna Carrizal se encuentra en un área aledaña a la costa, la misma se encuentra dentro de propiedad privada inscrita con el número de matrícula a mbre01 d de ASOCIACION DE LA COMUNIDAD DE BAJAMAR CEDULA JURIDICA CED01. Adicionalmente sobre los hechos denunciados no se ha tenido indicios o información de testigos para poder identificar a la persona o personas imputadas.” TERCERO: Que el señor Jeffry Hernández, Director Regional Área de Conservación Pacífico Central, señaló en oficio SINAC-ACOPAC-D029-2024 del 02 de febrero del 2024: “Como se puede ver del informe remitido de la oficina Subregional que atendió el caso se cumplió a cabalidad con la atención de la denuncia interpuesta en acatamiento de lo indicado en el Oficio Circular SINACSE-DE-356-2023, en el que se indica las actividades a realizar por parte del personal de control y protección del SINAC.Aunado a ello la denuncia interpuesta se le asigno el número de expediente judicial [Valor 003], conforme consulta realizada por la Asesoría legal del ACOPAC ante la Fiscalía de Garabito.” PETITORIA Se solicita respetuosamente, se declare sin lugar el recurso de amparo interpuesto por el señor Nombre02 por cuanto no existe vulneración de derecho fundamental alguno del amparado y las actuaciones de mi representada se han realizado conforme las competencias legales del Sistema Nacional de Áreas de Conservación, siendo que el Área de Conservación Pacífico Central atendió e interpuso la respectiva denuncia ambiental ante la Fiscalía de Garabito y realizo acciones a nivel administrativo en la plataforma SITADA”.
  5. 5Por escrito incorporado al expediente digital el 12 de febrero de 2024, rinde informe bajo juramento Tobías Murillo Rodríguez, alcalde de Garabito, en los siguientes términos: “Que mediante oficio SAM-046-2024 se la (sic) dio respuesta al recurrente al correo electrónico que el mismo aporto (sic)”.
  6. 6Por constancia de 12 de febrero de 2024, Mariane Castro Villalobos y Orlando Loría Vargas, por su orden secretaria a.i. y técnico judicial 3, hicieron saber: “revisado, a las trece horas dieciocho minutos del doce de febrero de dos mil veinticuatro, en el sistema costarricense de gestión de despachos judiciales el control de documentos recibidos y este expediente, no apareció que del 05/02/2024 al 08/02/2024, el PRESIDENTE DEL CONCEJO Y EL ENCARGADO DE GESTIÓN AMBIENTAL, AMBOS DE LA MUNICIPALIDAD DE GARABITO hayan presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las diecisiete horas cuarenta y seis minutos del treinta de enero de dos mil veinticuatro”.
  7. 7Por escrito incorporado al expediente digital el 13 de febrero de 2024, se apersona el accionante. Indica:“1.- En Seguimiento y Revisión del Expediente de este Caso, he Visualizado los INFORMES DE LEY Rendidos ya por los Funcionarios del MINAE, SINAC y ACOPAC, en cuanto a la Situación de mi Reclamo y a la AFECTACIÓN MAYOR COMPROBADA DE LA "ZONA PROTEGIDA" DEL HUMEDAL DE LA LAGUNA CARRIZAL. Y Verdaderamente me Quedado Absoluta y Negativamente Sorprendido de CÓMO los Señores del MINAE (sentido amplio), PESE AL ENORME BAGAJE DE NORMAS JURÍDICAS (CONSTTUCIÓN POLÍTICA, TRATADOS INTERNACIONALES, LEYES FORMALES Y DEMÁS NORMAS); PESE A TODAS SUS OBLIGACIONES, DEBERES, RESPONSABILILIDADES, ATRIBUCIONES, COMPETENCIAS Y MEDIOS FÁCTICO/JURÍDICOS DE ACCIÓN, Indican que SE DAN POR SATISFECHOS CON HACER UNA INSPECCIÓN DE SITIO DE DENUNCIA EN LA QUE COMPRUEBAN EL DAÑO AMBIENTAL DEL CASO SIN NINGÚN SEGUMIENTO PARA VER EL DEVENIR DELA AFECTACIÓN A UN IMPORTANTE SITIO NATURAL, Y Realizando Luego una "Denuncia Penal" la cual NI EL NUMERO SABEN LUEGO Y DEJAN TIRADA ANTE EL MINISTERIO PÚBLICO PARA QUE ÉSTE (DE POR SÍ STURADO DE TRABAJO), SEA EL QUE “SE ENCARGUE DEL CASO” Y Ellos, desde la Perspectiva Administrativa, pese a Todas las Armas Legales que Presentan y como se Dijo, a Todas sus Responsabilidades de Ley: DETERMINAN NO HACER NADA, Dejar que las Cosas Sigan Adelante, SIN MÁS NI MÁS.Con la Mayor Desidia y Negligencia Posibles. REALMENTE ES INVEROSÍMIL LO RESPONDIDO POR LOS SEÑORES DEL MINAE Y LO QUE ABIERTAMENTE RECONOCEN. BAJO ESAS CONDICIONES Y OMISIONES DE ACCIONES DEBIDAS, PARA QUÉ MINAE? Resultando que a Decir de los Señores de este Ministerio, ELLOS ADMINISTRATIVAMENTE NO PUEDEN HACER NADA. Cuando lo Real es QUE NO QUIEREN HACER NADA! Y ante esa Posición IMPROCEDENTE es que Debo Reaccionar y Manifestarme. Pidiendo a esa Honorable Sala que Declare CON LUGAR el Amparo y le Ordene a las Autoridades del MINAE que, en lo Inmediato, ACTÚEN, QUE TOMEN ACCIONES CONSECUENTES Y DETENGAN, PROTEJAN Y TOMEN ACCIONES CORRECTIVAS EN CUANTO A UN TERRENO PÚBLICO/ESTATAL QUE ESTÁ BAJO SU REAUDO Y QUE ES UNA ZONA PROTEGIDA AMBIENTAL, UN HUMEDAL. SOBRE EL CUAL DEBEN EJERCER TODAS LAS ACCIONES DE DEFENSA DE RIGOR Y NO LIMITARSE A, PESE HABER COMPROBADO EN SU "INSPECCION" LOS DAÑOS AMBIENTALES DENUNCIADOS: NO TOMAR NINGUNA ACCIÓN DESDE AL ÁMBITO DE LA VÍA ADMINISTRATIVA QUE LES ES ABSOLUTAMENTE PROPIA.El Artículo 111 de la Ley Orgánica del Ambiente, No. 7554, sigue Indicando, Expresamente: ..."Las infracciones a la legislación ambiental, que no sean competencia del Tribunal Ambiental Administrativo, serán de conocimiento de:1) El Ministerio de Ambiente y Energía (Minae) y la Contraloría Ambiental, a través del Sistema Integrado de Trámite y Atención de Denuncias Ambientales (Sitada).2) La Secretaría Técnica Nacional Ambiental, cuando exista un expediente administrativo abierto para la actividad, obra o proyecto en cuestión.3) En la municipalidad de la jurisdicción respectiva, cuando se trate de asuntos relacionados con los permisos de construcción " Y NO OBSTANTE ELLO, LA VOLUNTAD MANIFIESTA DE LOS SEÑORES DEL MINAE, ES ESQUIVAR SUS RESPONSABILIDADES Y POSIBLES ACCIONES Y NO HACER NADA EFECTIVO DESDE EL ÁMBITO DE SUS RESPONSABILIDADES ADMINISTRATIVAS. 2.- Unido y Ligado a lo anterior, dado que el MINAE y la Municipalidad de Garabito SIGUEN SIN TOMAR NINGUNA ACCIÓN EFECTIVA, los Señores que han INVADIDO y AFECTADO EL ÁREA PROTEGIDA DE LA "LAGUNA CARRIZAL", CONTINÚAN CON SUS ACCIONES IMPROPIAS. Luego de un Par de Semanas sin Acciones de Afectación de la Zona, al Ver el Reverdecer de la Zona que HAN AFECTADO, Volvieron a Meter los Tractores y a Repasar los Movimientos de Tierras. Eliminando la Flora que Estaba Resurgiendo Nuevamente y TOMANDO ACCIONES CONTRA LOS VECINOS QUE HEMOS ACTUADO EN PROTESTA A SU INDEBIDA GESTIÓN. Colocando Cantidades Significativas de Tierra y Piedras Enormes contra las Tapias de Nuestras Propiedades y Falseando y Afectando las Tapias de Algunos de Nosotros. Para Determinarnos una Imposibilidad Total de Acceso a la Zona Pública de la Laguna. A la Cual Accedemos para Eliminar Pequeñas Quemas No Controladas y Eliminar Residuos y Basura que Dejan los Visitantes. LO CUAL, AHORA YA NO PODEMOS HACER, según se Grafica con las Fotografías que de Seguido Inserto. FOTOGRAMAS (TODAS) QUE CORRESPONDEN A LA SEMANA PASADA DEL 4 AL 10 DE FEBRERO DEL AÑO EN CURSO: Fotos de Nuevas Acciones de Remoción de Flora y Fauna de la Zona: (…) Lo anterior es lo Dable a Evidenciar y Manifestar de Mi Parte. Sigo en Espera de Ver CON QUÉ CUENTO SALE LA MUNICIPALIDAD DE GARABITO, ANTE SUS INACCIONES DENUNCIADAS Y ANTE SU RENUENCIA TOTAL A DECIRNOS SÍ HA EMITIDO O NO ALGÚN PERMISO DE CONSTRUCCIÓN DE CAMINOS Y/O DE URBANISMO O CONSTRUCCIÓN DE VIENDAS EN LOS TERRENOS DE LA LAGUNA DE CARRIZAL” (sic).
  8. 8Por escrito incorporado al expediente digital el 14 de febrero de 2024, se apersona la parte recurrente. Manifiesta: “como Accionante, Preocupado y Afectado por Situaciones Mayores de Afectación Ambiental que se han Generado en el Entorno de la “Zona Protegida” del Humedal de la “LAGUNA CARRIZAL”, en Mérito de lo que se Verá y Dirá, con el Mayor Respeto me Presento a efecto de Exponer y Manifestar: En Seguimiento y Revisión del Expediente de este Caso, he Visualizado el Parco INFORME DE LEY Rendido PARCIALMENTE por los Señores de la Municipalidad de Garabito. Y en Virtud de lo que el mismo Señala, Me Resulta meritorio Hacer Ver y Recalcar lo Siguiente. 1.- Primero que Todo, ni los Señores del Concejo Municipal, ni los Señores de las Unidades Relacionadas con los Asuntos Ambientes y de Construcción del Municipio del Cantón de Garabito, SE PRONUNCIAN en cuanto a mi Amparo. Desatendiendo, en Absoluto Irrespeto y Desidia, lo Requerido por esa Sala y Reiterando su Actuar Omisivo en cuanto a la Relevante Situación de Afectación Ambiental que Hemos Denunciado y por la cual Hemos Accionado ante esa Municipalidad, SIN MAYORES, NI DEBIDOS RESULTADOS. 2.- Por su Parte, el Alcalde de Garabito Rinde un “Informe de Ley” de UN REGLÓN y LO QUE DICE NO ES CORRECTO NI AJUSTADO A LA VERDAD.El manifiesta que “MEDIANTE OFICIO SAM-046-2024 SE LA (SIC) DIO RESPUESTA AL RECURRENTE AL CORREO ELECTRÓNICO QUE EL MISMO APORTÓ”. Lo cual NO ES CIERTO. El Oficio que se menciona es un Documento Interno del Área de Fecha 6 de Febrero del 2024, del Área de Servicios Ambientales y Municipales a la Unidad de Gestión Jurídica de esa Municipalidad, para que se Dé Respuesta a Nuestro Amparo. NO ES UN DOCUMENTO DIRIGIDO AL SUSCRITO, NI QUE CONTENGA UNA RESPUESTA DEBIDA A MIS DENUNCIAS Y, ADEMÁS, NUNCA SE NOS ENVIÓ POR EL CORREO DISPUESTO AL EFECTO. Amén de lo que SE BUSCA NO ES UNA RESPUESTA EN PAPEL, SINO ACCIONES DE RIGOR, SEGÚN LAS COMPETENCIAS, RESPONSABILIDADES, DEBERES, OBLIGACIONES Y ATRIBUCIONES DE LA MUNICIPALIDAD, PARA PROTEGER EL MEDIO AMBIENTE Y RESTRINGIR CONSTRUCCIONES DE ACCESOS, VIAS INTERNAS Y CONSTRUCCIONES EN LA ZONA PROTEGIDA Y DE RESERVA DE LA LAGUNA CARRIZAL. LO CUAL SIGUEN SIN HACER.Violentando lo Dispuesto por el Numeral 111 de la Ley Orgánica del Ambiente, No. 7554, el cual sigue Indicando, Expresamente: …”Las infracciones a la legislación ambiental, que no sean competencia del Tribunal Ambiental Administrativo, serán de conocimiento de:1) El Ministerio de Ambiente y Energía (Minae) y la Contraloría Ambiental, a través del Sistema Integrado de Trámite y Atención de Denuncias Ambientales (Sitada).2) La Secretaría Técnica Nacional Ambiental, cuando exista un expediente administrativo abierto para la actividad, obra o proyecto en cuestión.3) En la municipalidad de la jurisdicción respectiva, cuando se trate de asuntos relacionados con los permisos de construcción.”… 3. Y al Analizar el Contenido del Documento No. SAM-046-2024, antes aludido y que se Remite como “PRUEBA” del Exiguo Informe de Ley Rendido por el Alcalde Municipal, Nos Encontramos con lo Siguiente: - Inician “Quitándose el Tiro” e Indicando que sería un Asunto del MINAE. DEJANDO DE LADO TODAS SU OBLIGACIONES Y RESPONSABILIDADES EN MATERIA AMBIENTAL Y DE CONSTRUCCIONES INDEBIDAS. - Señalan FALSAMENTE que el Día 29 de Enero de este año, Nos Brindaron Respuesta al Correo de Nuestro Abogado: [...]. LO CUAL NO ES CIERTO. El Ingeniero Johan Ramírez le Pidió a Nuestro Abogado su Número Telefónico para Indicarle que Debía Dirigir Mi Denuncia al MINAE y NO A LA MUNICIPALIDAD. Y ante esa Gestión Impropia, Nuestro Abogado le Respondió: …“Ingeniero, muy buenas tardes. Perdone que hasta ahora atienda su correo, pero a solicitud de mi Cliente hoy he estado ocupado interponiendo un Amparo a efecto de que las diversas administraciones con competencias, deberes, responsabilidades y obligaciones en el caso, sean compelidas por la Sala Constitucional a actuar. Ya el SITANA ha conocido del caso e interpusieron una Denuncia Penal. Pero esa gestión es SOLO en cuanto a la potencial responsabilidad Penal por la afectación del Humedal. Y DESDE LA PERSPECTIVA DE LAS COMPETENCIAS ADMINISTRATIVAS, ES DE RIGOR QUE TAMBIÉN ACTÚEN. YA SEA EL SITANA MISMO O LAS DEPENDENCIAS DEL SINAC/MINAE. Desde la perspectiva Municipal, los AVISOS que los Invasores han puesto, Anuncian un Desarrollo Urbanístico. Se han dado aperturas de Caminos y la Creación de un Acceso Indebido al Final de una Vía Pública, alistando el terreno para Construcciones???. Hemos pedido se nos Indique sí hay Permisos de Construcción dados por ese Municipio (SIN RESPUESTA ALGUNA). Así que en lo que Atañe a esa Municipalidad, sí la misma cuenta con una Oficina Ambiental, es por y para algo. ADEMÁS, EN LOS DEMÁS ÁMBITOS COMPROMETIDOS, ES ESA MUNICIPALIDAD LA LLAMADA A ACCIONAR Y CLAUSURAR CONSTRUCCIONES NO AUTORIZADAS. MÁXIME EN UN ZONA PROTEGIDA Y PÚBLICA. Y RESTRINGIR ACCESO EN VÍAS PÚBLICAS DETERMINADAS COMO DE SIN SALIDAS. En fin, y con todo respeto, estimamos que según sus Diversas Competencias, Deberes, Atribuciones, Obligaciones y Responsabilidades de LEY, hemos cursado nuestras Gestiones Primarias ante los órganos que corresponde. Y LOS MISMOS DEBEN DE ACTUAR SEGÚN LES COMPETE.”… Como Prueba de lo Realmente Acontecido, se Acompaña el Intercambio de Correos en cuanto a lo Particular. SIENDO PRECLARO QUE EN LOS CORREOS ALUDIDOS NO HAY UNA RESPUESTA MERITORIA, NI ACCIONES DEBIDAS EN CUANTO A LO DE MI DENUNCIA AMBIENTAL. - Finalmente, se Evidencia que Visitaron el Sitio y que Reconocen que Hay Afectaciones Constructivas y Ambientales. PERO QUE NO HICIERON NADA. Dicen que una Zona Absolutamente Aledaña al Humedal LAGUNA CARRIZAL es “PRIVADA” y que NO PUEDEN ENTRAN, NI HACER NADA. Lo cual NO ES DABLE, NI CIERTO. PUES NUNCA LA ZONA AFECTADA PUEDE SER DE ORDEN PRIVADO. PUEDE ESTAR INSERTA DENTRO DE UNA PROPIEDAD PRIVADA, PERO LA LAGUNA SE FORMA COMO UNA EXTENSIÓN DE LA INSERCIÓN DEL MAR HACIA LA COSTA Y ESTA, PER SE, AFECTADA A LA LEY DE ZONA MARÍTIMO TERRESTRE Y A LOS RETIROS DEBIDOS, SEGÚN DICHA NORMATIVA O SEGÚN LA NORMATIVA DE AMBIENTAL DEL CASO (Aguas). ADEMÁS, ES UNA ZONA CON MANGLAR. EL MISMO PLAZO DE LA PROPIEDAD A LA QUE ALUDEN SEÑALA LAS LIMITACIONES Y RESERVAS DEL CASO: (…) TAMBIÉN SE RECONOCE QUE NO HAY PERMISO ALGUNO DE CONSTRUCCIÓN DADO PARA LA ZONA DE DENUNCIA. Y Siendo Paradójico y Absolutamente Contradictorio que Digan que NO HACEN NADA; pero que REMITAN A UNA ACTA DE CLAUSURA DEL AÑO 2021, EN EL ENTORNO DE LAS PROPIEDADES ALEDAÑAS A LA LAGUNA AFECTADA. LO CUAL DEMUESTRA QUE SÍ PEDEN CLAUSURAR LAS OBRAS DE ACCESOS ILEGALES, CAMINOS INTERNOS Y REMOSIÓN DE ÁRBOLES Y CAPA VEGETAL (LABORES CONSTRUCTIVAS) Y SUPRESIÓN DE LA FAUNA, QUE SE HAN DESARROLLADO SIN PERMISO ALGUNO, DE FORMA ILEGAL Y AFECTANDO EL MEDIO AMBIENTE. ENTONCES: POR QUÉ NO LO HACEN? EN UNA DESIDIA TOTAL. Lo anterior es lo Dable a Manifestar y Recalcar de mi Parte. Pido lo Tomen en Estima a los Efectos de DECLARAR CON LUGAR Mi Amparo, CON TODOS LOS EFECTOS DE LEY”
  9. 9En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I.Cuestión previa. Visto que el presidente del Concejo y el encargado de Gestión Ambiental, ambos de la municipalidad de Garabito, omitieron rendir el informe solicitado dentro del plazo conferido, de conformidad con el artículo 45 de la Ley de la Jurisdicción Constitucional, se tienen por ciertos los hechos en cuanto a estas autoridades y se entra a resolver el recurso con base en los demás elementos que constan en el expediente.

II.Objeto del recurso. La parte accionante indica que hace unos años adquirió un terreno en la zona aledaña y limítrofe a la Laguna de Carrizal, en el sector de Bajamar, en Garabito de Puntarenas, la cual es un humedal reconocido que forma parte del corredor biológico Paso Las Lapas. Aduce que en esa zona se iniciaron acciones de invasión a la zona protegida de la laguna en una calle sin salida que termina en el límite de esta, abrieron un acceso no autorizado y comenzaron con labores de eliminación tanto de la capa vegetal como de la flora y fauna; además realizaron movimientos de tierra y quemas no controladas. Relata que a finales de octubre de 2023 denunció lo acontecido ante las autoridades recurridas, además no solo evidenció la invasión y los daños ambientales producidos, sino que también solicitó que se ejecuten acciones al respecto. Sostiene que, desde ese momento, las acciones de invasión y afectaciones han sido mayores, lo cual ha sido ampliado en las respectivas denuncias.

Acusa que no ha obtenido respuesta de la municipalidad. la respuesta de la municipalidad recurrida. Acota que el SITADA del Minae, mediante correo electrónico de 22 de enero de 2024, le comunicó que habían constatado tanto las invasiones como las afectaciones ambientales; además, que se limitaron a formular la denuncia ante la fiscalía de Garabito. Refiere que ante esa respuesta solicitó que le indicaran por qué no tomaban alguna acción cautelar en vía administrativa, tal como eliminar el acceso indebido abierto por los invasores; sin embargo, no ha habido respuesta ni acciones de control. Alega que ha advertido ante la municipalidad recurrida labores de movimientos de tierras y de construcción en el área protegida de la laguna, así como ha pedido información y acciones desde la perspectiva de las normas, construcciones y fraccionamientos; no obstante, tampoco le han contestado. Explica que la inacción de las autoridades recurridas ha permitido que los invasores se adueñen más de la zona.

Asevera que entre el 24 y 26 de enero de 2024 se eliminó prácticamente tanto la capa vegetal como la flora y fauna que quedaba. Pide que se declare con lugar el recurso y que, como medida cautelar, se ordene a las autoridades accionadas detener las obras y bloquear el acceso.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)Con respecto al Sinac:

i. El 25 octubre de 2023 se planteó a través del Sistema Integrado de Trámite de Denuncias Ambientales (Sitada) de la Contraloría Ambiental del Minae, una denuncia a Nombre01 del tutelado dirigida a “Señores Sistema Nacional de Áreas de Conservación (SINAC) MINISTERIO DEL AMBIENTE Y ENERGÍA (MINAE) Presente Señores Sistema de Área de Conservación Pacífico Central (ACOPAC) Sistema Nacional de Áreas de Conservación (SINAC) MINISTERIO DEL AMBIENTE Y ENERGÍA (MINAE) (…)” con el siguiente contenido: “(…) me Presento a efecto de Realizar la Presente DENUNCIA, en cuanto a Muy Posibles situaciones de “Afectación” en cuanto al HUMEDAL DE LA LAGUNA CARRIZAL. Y a los efectos de mi Presente Gestión, Realizo las Siguientes Consideraciones: ACLARACIÓN PRIMARIA: Esta Gestión de Dirige a Todas sus Autoridades (Administrativas), en Rigo de las obligaciones, Deberes, Responsabilidades y Competencias que por Ley (sentido laxo), Presentan a efecto de Intervenir y de Tomar Acciones de Control, Protección y Sanción en cuanto a la Relevante Temática Ambiental que Entraña esta Denuncia.

Teniéndose que en Mérito de la misma, Todas y Cada una de esas Dependencias Destinatarias, ante las que se Gestiona, presentan Obligación de Proceder (Arts. 11, 27, 30, 41, 50 y 129 de la Constitución Política). SOBRE EL HUMEDAL EN CUESTIÓN: Por lo que hemos Podido Verificar, la LAGUNA DE CARRIZAL es efectivamente un Humedal Reconocido, el cual Forma Parte de el Corredor Biológico Paso las lapas. Se Ubica en el Distrito de Tárcoles, Cantón de Garabito, Provincia de Puntarenas. Hoja Cartográfica BARRANCA. Latitud: 9º 50´13” y Longitud 64º 40’ 40”. (…) EN CUANTO A LA PERSPECTIVA DE MI DENUNCIA: Como ya dije, pese a ser Comerciante en San José, desde hace Varios Años Soy Dueño/Usufructuario debido de un Terreno en la Zona de Carrizal. Mismo que en su Lindero Oeste Colinda con la Zona de la Laguna de Carrizal. El acceso a mi Propiedad se da por era una Calle sin Salida, la cual TOPA CON EL REFERIDO HUMEDAL, SIN DAR NINGÚN ACCESO AL MISMO.

(…) Primeramente, hace unas Semanas, un Grupo de Personas cuya identidad Desconozco, Vino y Realizó una Construcción de un PORTÓN DE ACCESO A LA ZONA DE HUMEDAL, AL FINAL DE LA CALLE SIN SALIDA ANTES ALUDIDA. Luego, estas mismas Personas han Iniciado a Realizar Quemas en la Zona del Humedal. MISMAS QUE NO SÉ EN CUANTO AFECTA ESTA ZONA PROTEGIDA. Y Hace unos Días, los Señores en cuestión, me han Contactado para Ofrecerme VENDER y/o Urbanizar la Zona Posterior o Trase a mi Propiedad, la cual Yo Tengo Identificada como Parte del Humedal de la Laguna Carrizal. Siendo tales Hechos Evidentes de un Posicionamiento y Potencial Desarrollo Urbanístico en la Zona del Humedal Referido. Y Siendo ello lo que me Lleva a Acudir a sus Autoridades, como Necesarias y/o Potenciales Intervinientes, en cuanto a Alguna Situación Relacionada con la Zona Protegida dicha. (…) PETICIÓN DE CURSO, INVESTIGACIÓN E INFORMACIÓN: 1.

Dado lo que se Informa y Denuncia por este medio a Todas sus Autoridades, SE LES PONE ASÍ EN CONOCIMIENTO, a Todos los Efectos de Ley y de Rigor, en cuenta sus Responsabilidades por Omisión o Incumplimiento de sus Funciones, Atribuciones y Deberes (Potencial Culpa Grave y/o Negligencia). Esto en caso de Permitirse o Tolerarse por Omisión, la Potencial Invasión y/o Afectación del Humedal sobre el cual Versa esta Denuncia. 2- En cuanto a las Autoridades del MINAE a las que se Cursa esta Denuncia, se Requieren Todas sus Acciones de investigación, Control, Resguardo y Sanción en cuanto lo de Denuncia y en cuanto a la Efectiva Protección del humedal sobre el cual Versa esta Denuncia. Y que se investiguen y Accionen en cuanto a la Apertura de un Acceso indebido (Portón) al Humedal aludido. (…) Y EN RELACIÓN CON TODOS LOS DESTINATARIOS DE ESTA DENUNCIA, EL SUSCRITO SE TORNA EN INTERESADO DIRECTO Y PIDE QUE SE NOS BRINDE RESPUESTA E INFORMACIÓN SOBRE LAS ACCIONE QUE SEAN TOMADAS POR ESAS DEPENDENCIAS ESTO DENTRO DE LOS TÉRMINOS DE LEY.

QUEDANDO EN ESPERA DE UNA RESPUESTA DEBIDA Y EFECTIVA (ARTS. 27, 30 Y 41 DE LA CONSTITUCIÓN POLÍTICA). NOTIFICACIONES: Las Atenderé al Correo Electrónico de mi Abogado. Lic. Mario Quesada Aguirre. [...]. San José, 24 de Octubre del 2023” (sic). (Prueba aportada por el recurrente y las autoridades del Sinac).

ii. A la queja del accionante ingresada en el Sitada se le asignó el registro nro. 43570-2023. (Prueba aportada por el recurrente y por las autoridades del Sinac).

iii. El Acopac, mediante acta de inspección ocular de las 8:41 horas de 22 de noviembre de 2023, hizo constar: “Se realiza inspección para atender denuncia ingresada en Sitada relacionada con invasión del area (sic) de protección de la Laguna Carrizal, la denuncia menciona la colocación de un portón de acceso a la Laguna, en esta inspección se comprueba lo denunciado, se toman coordenadas, mediciones así como fotografías, ademas (sic) se localiza la realización de un camino paralelo a la laguna realizado presuntamente con maquinaria, lo localizado en el area (sic) de protección de la laguna corresponde a un portón de madera y metal de color negro con 5 metros de ancho por 1.40 m de alto una pared de cemento y cerámica junto al portón de 2.28 m de acho por 1.61 m de alto además una cerca de alambre de púa de 9 m de ancho perpendicular al borde de la laguna, el camino que se encuentra junto al portón y que va en dirección este tiene una medida de 60 m de largo por 4.30 m de ancho. Es todo ” (Prueba aportada por las autoridades del Sinac).

iv. El 22 de enero de 2024, la encargada del Programa Prevención, Protección y Control del Enlace Programa Vida Silvestre de la Oficina Subregional de Orotina del Acopac del Sinac, comunicó al correo electrónico [...], lo siguiente: “Por este medio le informo que con relación a la queja ingresada en SITADA con el número de registro 43570-2023 la misma fue atendida (ver el acta de inspección ocular ingresada en la plataforma), y el informe fue presentado en la Fiscalía de Garabito el día jueves 18 de enero de 2024 con el número de informe SINAC-ACOPAC-OSRO-PPC-223-2023. El número de expediente judicial no lo tenemos pues la Fiscalía de Garabito no nos da el numero (sic) en el momento que se entrega el mismo. Considero importante además mencionarle que sobre el caso en cuestión se presentó una denuncia en la misma Fiscalía en el año 2021 en atención a la queja SITADA 25424-2021 por medio del informe SINAC-ACOPAC-DRFVS-055-2021 suscrito por el funcionario Gil Ruiz expediente judicial [Valor 006].

Además en el año 2022 se presentó el informe policial SINAC-ACOPAC-OSRO-551-2022 suscrito por mi persona como ampliación al expediente judicial [Valor 002]. Así mismo en ese mismo año el funcionario Adrian (sic) Arce suscribió el informe SINAC-ACOPAC-PINV-005-2022. Todos los informes relacionados con afectaciones realizados por quemas tanto en los alrededores de la Laguna Carrizal como en sectores que se encontraban a Nombre01 de la Asociación de vecinos de Bajamar. Finalmente informarle que a la fecha se desconoce el estado de dicha causa o causas”. (Prueba aportada por el recurrente y las autoridades del Sinac).

v. La encargada del Programa de Prevención, Protección y Control de la oficina Subregional Orotina del Área de Conservación Pacífico Central, en el oficio SINAC-ACOPAC-OSRO-PPC-020-2024 del 1º de febrero de 2024, consignó: “La queja fue atendida el día 22 de noviembre de 2023, cuya acta de inspección ocular se ingresó en la plataforma SITADA el mismo día, posteriormente el informe fue presentado en la Fiscalía de Garabito el día jueves 18 de enero de 2024 con el número de informe SINAC-ACOPAC-OSRO-PPC-223-2023. A la fecha no se cuenta con el número de expediente judicial pues la Fiscalia (sic) de Garabito no nos da el numero en el momento que se entrega el mismo, y en consecuencia no se ha adjuntado dicho informe para seguimiento de la Asesoría Legal en la plataforma. Sobre el caso de la Laguna Carrizal además de la presente queja, se han atendido otras quejas siendo que se presentó una denuncia en la misma Fiscalia (sic) en el año 2021 en atención a la queja SITADA 25424-2021 por medio del informe SINAC-ACOPAC-DRFVS-055-2021 suscrito por el funcionario Gil Ruiz expediente judicial [Valor 007].

Además en el año 2022 se presentó el informe policial SINAC-ACOPAC-OSRO-551-2022 suscrito por mi persona como ampliación al expediente judicial [Valor 002]. Así mismo en el año 2021 el funcionario Adrian (sic) Arce suscribió el informe SINAC-ACOPAC-PINV-005-2022. Todos los informes son relacionados con afectaciones realizadas por quemas tanto en los alrededores de la Laguna Carrizal como en sectores que se encontraban a Nombre01 de la Asociación de vecinos de Bajamar. Por otro lado, es importante mencionar que, si bien la Laguna Carrizal se encuentra en un area (sic) aledaña a la costa, la misma se encuentra dentro de propiedad privada inscrita con el número de matrícula a mbre01 d de ASOCIACION (sic) DE LA COMUNIDAD DE BAJAMAR CEDULA (sic) JURIDICA (sic) 3-002-320413. Adicionalmente sobre los hechos denunciados no se ha tenido indicios o información de testigos para poder identificar a la persona o personas imputadas”. (Prueba aportada por las autoridades del Sinac).

vi. El oficio SINAC-ACOPAC-OSRO-PPC-223-2023 de 29 de diciembre de 2023 dirigido a la Fiscalía de Garabito, señala: “ASUNTO: Informe por daños al ambiente Estimados señores: Quien suscribe, Stephanie Paola Alvarado Ledezma (…) Funcionaria del Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, actuando en calidad de autoridad de policía, según el artículo 54 de la Ley Forestal y artículo 16 de la Ley de Vida Silvestre, destacada jurisprudencialmente en la Oficinal Sub Regional de Orotina, me presento ante su autoridad con la finalidad de informar los siguientes hechos en contra de los Recursos Naturales que se detallan a continuación: 1. HECHOS PRIMERO: Mediante el Sistema Integrado de Tramite (sic) de Denuncias Ambientales (SITADA) se recibió una denuncia la cual contiene un escrito adjunto, que menciona la afectación al humedal Laguna Carrizal, ubicada en Bajamar, Tárcoles, Garabito.

SEGUNDO: Por lo que el día 22 de noviembre de 2023 a las 08:40 horas se procedió a atender la queja en compañía de funcionarios de la Unidad Ambiental del Servicio Nacional de Guardacostas de la Estación de Caldera. TERCERO: En el sitio, que se ubica al costado Norte de la Laguna Carrizal se localiza un portón de madera y metal de color negro con 5 metros de ancho por 1.40 m de alto, junto al portón se ubica una pared de cemento y cerámica de 2.28 m de ancho por 1.61 m de alto. CUARTO: Además se localiza una cerca de alambre de púa de 9 m de largo, que se ubica perpendicular al borde la laguna. QUINTO: Además se localiza la apertura de un camino aparentemente realizado con maquinaria, el mismo inicia junto al portón descrito anteriormente, y se encuentra paralelo al borde de la laguna, tiene una medida de 60 m de largo por 4.30 de ancho. SEXTO: Lo localizado en esta inspección se encuentra dentro del area (sic) de protección de la Laguna Carrizal (50 m) como se puede observar en la figura 1.

SETIMO (sic): Que según la verificación de coordenadas por medio del programa Quantum GIS y según la información que consta en las capas de información del Registro Inmobiliario del SNIT (Sistema Nacional de Información Territorial) del Registro Nacional, el inmueble donde se realizó el camino se encuentra inscrito con el número de finca 45588---000 a Nombre01 de [Nombre01 003] Cedula (sic) identidad [CED02], [Nombre 004] Cedula (sic) identidad [CED03], [Nombre 005] Cedula (sic) identidad [Valor 010], [Nombre 006] (sic) Cedula (sic) identidad [Valor CED05]. OCTAVO: Por otro lado, el portón se ubica en un area (sic) donde finaliza un camino público, lo anterior de acuerdo a (sic) la capa de información de vías públicas. NOVENO: En esta inspección no solamente se detecta lo que informa el señor [Nombre01 001], sino que también se detecta que la propiedad que colinda con los hechos denunciados posee una tapia de cemente la cual contiene 96 m dentro del área de protección de la Laguna Carrizal, además de que hay dos edificaciones dentro del area (sic) de protección.

Lo anterior fue posible observarlo en la revisión de coordenadas y utilizando la imagen de Google Satélite, pues en el campo al estar cerrada la propiedad no se podía observar claramente. DECIMO (sic): La tapia así como las dos edificaciones se encuentran en la propiedad con numero (sic) de finca matrícula , a mbre01 d de [Nombre 007] (sic) Cedula (sic) identidad [Valor D06],], [mbre01 0 008] Cedula (sic) identidad [Valor D07]”]”. (Prueba aportada por el recurrente y las autoridades del Sinac).

  • b)En cuanto a la Municipalidad de Garabito:

i. En octubre de 2023, la Municipalidad de Garabito recibió una denuncia a Nombre01 del tutelado dirigida a “ Señor Alcalde Municipal y Miembros del Consejo (sic) Municipal MUNICIPALIDAD DE GARABITO Presente Señores Unidades de Servicios Técnicos y Servicios Ambientales MUNICIPALIDAD DE GARABITO (…)” con el siguiente contenido: “(…) me Presento a efecto de Realizar la Presente DENUNCIA, en cuanto a Muy Posibles situaciones de “Afectación” en cuanto al HUMEDAL DE LA LAGUNA CARRIZAL. Y a los efectos de mi Presente Gestión, Realizo las Siguientes Consideraciones: ACLARACIÓN PRIMARIA: Esta Gestión de Dirige a Todas sus Autoridades (Administrativas), en Rigo de las obligaciones, Deberes, Responsabilidades y Competencias que por Ley (sentido laxo), Presentan a efecto de Intervenir y de Tomar Acciones de Control, Protección y Sanción en cuanto a la Relevante Temática Ambiental que Entraña esta Denuncia.

Teniéndose que en Mérito de la misma, Todas y Cada una de esas Dependencias Destinatarias, ante las que se Gestiona, presentan Obligación de Proceder (Arts. 11, 27, 30, 41, 50 y 129 de la Constitución Política). SOBRE EL HUMEDAL EN CUESTIÓN: Por lo que hemos Podido Verificar, la LAGUNA DE CARRIZAL es efectivamente un Humedal Reconocido, el cual Forma Parte de el Corredor Biológico Paso las lapas. Se Ubica en el Distrito de Tárcoles, Cantón de Garabito, Provincia de Puntarenas. Hoja Cartográfica BARRANCA. Latitud: 9º 50´13” y Longitud 64º 40’ 40”. (…) EN CUANTO A LA PERSPECTIVA DE MI DENUNCIA: Como ya dije, pese a ser Comerciante en San José, desde hace Varios Años Soy Dueño/Usufructuario debido de un Terreno en la Zona de Carrizal. Mismo que en su Lindero Oeste Colinda con la Zona de la Laguna de Carrizal. El acceso a mi Propiedad se da por era una Calle sin Salida, la cual TOPA CON EL REFERIDO HUMEDAL, SIN DAR NINGÚN ACCESO AL MISMO.

(…) Primeramente, hace unas Semanas, un Grupo de Personas cuya identidad Desconozco, Vino y Realizó una Construcción de un PORTÓN DE ACCESO A LA ZONA DE HUMEDAL, AL FINAL DE LA CALLE SIN SALIDA ANTES ALUDIDA. Luego, estas mismas Personas han Iniciado a Realizar Quemas en la Zona del Humedal. MISMAS QUE NO SÉ EN CUANTO AFECTA ESTA ZONA PROTEGIDA. Y Hace unos Días, los Señores en cuestión, me han Contactado para Ofrecerme VENDER y/o Urbanizar la Zona Posterior o Trase a mi Propiedad, la cual Yo Tengo Identificada como Parte del Humedal de la Laguna Carrizal. Siendo tales Hechos Evidentes de un Posicionamiento y Potencial Desarrollo Urbanístico en la Zona del Humedal Referido. Y Siendo ello lo que me Lleva a Acudir a sus Autoridades, como Necesarias y/o Potenciales Intervinientes, en cuanto a Alguna Situación Relacionada con la Zona Protegida dicha. (…) PETICIÓN DE CURSO, INVESTIGACIÓN E INFORMACIÓN: 1.

Dado lo que se Informa y Denuncia por este medio a Todas sus Autoridades, SE LES PONE ASÍ EN CONOCIMIENTO, a Todos los Efectos de Ley y de Rigor, en cuenta sus Responsabilidades por Omisión o Incumplimiento de sus Funciones, Atribuciones y Deberes (Potencial Culpa Grave y/o Negligencia). Esto en caso de Permitirse o Tolerarse por Omisión, la Potencial Invasión y/o Afectación del Humedal sobre el cual Versa esta Denuncia. (…) 3.- En cuanto a las Autoridades de la Municipalidad de Garabito a las que se Cursa esta Denuncia, también se les Requieren Todas sus Acciones de Investigación, Control y Sanción en cuanto lo de Denuncia y en cuanto a la Efectiva Protección del Humedal sobre el cual Versa esta Denuncia. Así como se les previene a Efecto de que NO OTORGUEN Ningún Permiso de Loteo, Fraccionamiento, Construcción y/o Urbanización en la Zona de Humedal Señalado y Claramente Localizado. Y que Investiguen y Accionante en cuanto a la Apertura de un Acceso Indebido (Portón) al Humedal aludido.

Y EN RELACIÓN CON TODOS LOS DESTINATARIOS DE ESTA DENUNCIA, EL SUSCRITO SE TORNA EN INTERESADO DIRECTO Y PIDE QUE SE NOS BRINDE RESPUESTA E INFORMACIÓN SOBRE LAS ACCIONE QUE SEAN TOMADAS POR ESAS DEPENDENCIAS ESTO DENTRO DE LOS TÉRMINOS DE LEY. QUEDANDO EN ESPERA DE UNA RESPUESTA DEBIDA Y EFECTIVA (ARTS. 27, 30 Y 41 DE LA CONSTITUCIÓN POLÍTICA). NOTIFICACIONES: Las Atenderé al Correo Electrónico de mi Abogado. Lic. Mario Quesada Aguirre. [...]. San José, 24 de Octubre del 2023”. (Prueba aportada por el recurrente y las autoridades del Sinac).

ii. El coordinador a.i. y la analista de procesos superiores a.i, ambos de Servicios Ambientales y Municipales de la Municipalidad de Garabito, mediante oficio SAM-477-2023 de 31 de octubre de 2023 dirigido a “Tobías Murillo Rodríguez Alcalde Municipal Municipalidad de Garabito”, señalaron: “Con respecto a la solicitud realizada mediante el Oficio AMI-2237-2023-TM en relación con la boleta de documentos varios 41648-41647. “Les remito copia de boleta de documentos varios 41648-41647, suscrito por el señor [Nombre01 002] (sic) [Nombre01 001], donde remite formal denuncia por afectación al humedal de laguna Carriza, para que, en un plazo de 10 días hábiles, realicen un informe al respecto y comunique al administrad.” A partir de ello, se le informa que la denuncia fue ingresada al Sistema Integrado de Trámite de Denuncias Ambientales (SITADA) administrado por la Contraloría Ambiental y en el cual la Municipalidad de Garabito tiene un usuario.

Cabe destacar que la denuncia se identifica con código 43570-2023 y fue asignada por la Contraloría Ambiental al Sistema Nacional de Áreas de Conservación del Área de Conservación Pacífico Central (SINAC-ACOPAC), ya que es la dependencia del MINAE con las competencias para la atención de denuncias relacionadas al tema de humedales. Esto debido a que cuenta con expertos en la materia a diferencia de la Municipalidad de Garabito. Por tanto, el SINAC procederá a realizar la respectiva investigación y según se requiere el Departamento de Servicios Ambientales y Municipales le brindará el apoyo necesario desde sus competencias para la atención del caso (…)”. (Prueba aportada por el alcalde de Garabito).

iii. El coordinador a.i. y la analista de procesos superiores a.i, ambos de Servicios Ambientales y Municipales de la Municipalidad de Garabito, mediante oficio SAM-046-2024 de 6 de febrero de 2024 dirigido a “Señores (as) Gestión Jurídica Municipalidad de Garabito”, expusieron: “Por medio de la presente se les informa sobre lo actuado por el departamento de Servicios Ambientales y Municipales en relación a la denuncia realizada por el señor [Nombre01 001]: • El día 31 de octubre del 2023, mediante el oficio SAM-477-2023 se dio respuesta a la solicitud presentada en el oficio AMI-2297-2023›TM al correo electrónico ...01. En la que se le informa que la denuncia fue ingresada al Sistema Integrado de Trámite y Atención de Denuncias Ambientales (SITADA) y le fue asignada al Sistema Nacional de Áreas de Conservación (SINAC) para su atención. • El día 29 de enero del 2024, se dio respuesta a uno de los correos electrónicos provenientes de la dirección [...] desde los correos ...02 y ...03.

Donde se le solicita un número telefónico mediante el cual se pudiese contactar con el fin de brindarle la ayuda correspondiente desde nuestras competencias. • El día 6 de febrero del 2024, se realizó una inspección en el sitio indicado en conjunto con el Lic. Jason Angulo del Departamento de Servicios Técnicos – Zona Marítima Terrestre y la inspectora Vanessa Camacho del Departamento de Seguridad y Convivencia Social. EI inmueble en apariencia corresponde a la finca 0045251, propiedad privada a la que no se ingresó ya que no había personas en el sitio que nos permitieran el ingreso. No obstante, se verificó la existencia de permisos municipales otorgados y no existen. Asimismo, en los registros se encuentra el levantamiento del Acta de clausura 0079-2021 realizada en el año 2021. (…) Se adjunta Oficio SAM-477-2023 y comprobantes de los correos enviados en respuesta”. (Prueba aportada por el alcalde de Garabito).

IV.Hecho no probado. De importancia para la decisión de este asunto, se estima como no demostrado que la Municipalidad de Garabito hubiese notificado alguna respuesta al medio señalado por el recurrente en la gestión de octubre de 2023

V. Sobre los principios constitucionales en material ambiental

Concerniente a los principios preventivo y precautorio, en la sentencia nro. 2021024807 de las 9:20 horas del 5 de noviembre de 2021, esta Sala precisó:

“En este orden de ideas, la doctrina especializada ha señalado que el principio preventivo demanda que, cuando haya certeza de posibles daños al ambiente, la actividad afectante deba ser prohibida, limitada, o condicionada al cumplimiento de ciertos requerimientos. En general, este principio aplica cuando existen riesgos claramente definidos e identificados al menos como probables; asimismo, tal principio resulta útil cuando no existen informes técnicos o permisos administrativos que garanticen la sostenibilidad de una actividad, pero hay elementos suficientes para prever eventuales impactos negativos. Por otra parte, el principio precautorio señala que, cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente.

De lo anterior, se advierte que el principio parte de una incertidumbre científica razonable en conjunto con la amenaza de un daño ambiental grave e irreversible. En términos generales, una diferencia relevante entre el principio preventivo y el precautorio radica en el nivel de conocimiento y certeza de los riesgos que una actividad u obra provoque. Mientras que en el primero existe tal certeza, en el segundo lo que se advierte es un estado de duda resultado de informaciones científicas o estudios técnicos (…)” Justamente, el principio precautorio debe ser entendido como se contempla en el principio XV de la Declaración de Río sobre el Medio Ambiente y el Desarrollo: “Cuando haya peligro de daño grave o irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente”.

Es decir, no se trata de la exigencia de tener estudios científicos para arribar a la ‘certeza absoluta’ de la inocuidad de una actividad para con el ambiente (en tesis de principio una seguridad total difícilmente es alcanzable), sino, más bien, de que, aunque el peligro de un daño grave o irreversible al ambiente no esté del todo asegurado, tal incertidumbre jamás justificará ni excusará que se postergue la ejecución de medidas efectivas para impedir la degradación del ambiente. Al respecto, obsérvese, por un lado, que no se está ante cualquier tipo de amenaza, pues plausiblemente debe involucrar un peligro serio, y, por otro, que la medida demanda un uso eficaz y eficiente de los recursos empleados. En el sentido expuesto, aun cuando el principio precautorio está ligado a un cierto nivel de incerteza científica, ello no implica que se pueda emplear de forma irrestricta con el argumento de que cualquier actividad podría generar daños al ambiente lo que desnaturalizaría su razón de ser, sino que es menester que se cuente con cierto grado de identificación de los peligros de un daño grave o irreversible que se podría generar, cuya determinación varía en atención de las particularidades propias del caso concreto.

Así, cuando se está ante una situación que exige la aplicación del principio precautorio, los entes y órganos públicos deben abstenerse de autorizar, aprobar o permitir toda solicitud nueva o de modificación que razonablemente conlleve un riesgo grave; incluso, se encuentran obligados a suspender las actividades que se estén desarrollando. Paralelamente tienen que adoptar con eficiencia y efectividad todas las medidas requeridas para la preservación de un ambiente sano y ecológicamente equilibrado.

El referido principio se recoge de igual modo en una fuente jurídica del hard law, toda vez que el principio 3 de la Convención Marco de las Naciones Unidas sobre el Cambio Climático ratificada por Costa Rica mediante la ley nro. 7414 del 13 de junio de 1994 y por todos los estados miembros de la OEA- estatuye:

“3. Las Partes deberían tomar medidas de precaución para prever, prevenir o reducir al mínimo las causas del cambio climático y mitigar sus efectos adversos. Cuando haya amenaza de daño grave o irreversible, no debería utilizarse la falta de total certidumbre científica como razón para posponer tales medidas, teniendo en cuenta que las políticas y medidas para hacer frente al cambio climático deberían ser eficaces en función de los costos a fin de asegurar beneficios mundiales al menor costo posible. A tal fin, esas políticas y medidas deberían tener en cuenta los distintos contextos socioeconómicos, ser integrales, incluir todas las fuentes, sumideros y depósitos pertinentes de gases de efecto invernadero y abarcar todos los sectores económicos. Los esfuerzos para hacer frente al cambio climático pueden llevarse a cabo en cooperación entre las Partes interesadas” El principio precautorio también se encuentra previsto en el Convenio de Estocolmo sobre Contaminantes Orgánicos Persistentes, el cual se encuentra ratificado por 32 Estados Miembros de la OEA, entre ellos, Costa Rica véase ley nro. 8538 del 23 de agosto de 2006 , en la que se lee:

“ARTÍCULO 1 Objetivo Teniendo presente el principio de precaución consagrado en el principio 15 de la Declaración de Río sobre el Medio Ambiente y el Desarrollo, el objetivo del presente Convenio es proteger la salud humana y el medio ambiente frente a los contaminantes orgánicos persistentes (…)”.

Igualmente, tal principio está contemplado el Convenio sobre la Diversidad Biológica ratificado por 34 Estados Miembros de la OEA, incluido Costa Rica, por medio de la ley nro. 7416 del 30 de junio de 1994, en cuyo preámbulo se establece: “(…) Observando que es vital prever, prevenir y atacar en su fuente las causas de reducción o pérdida de la diversidad biológica. Observando también que cuando exista una amenaza de reducción o pérdida sustancial de la diversidad biológica no debe alegarse la falta de pruebas científicas inequívocas como razón para aplazar las medidas encaminadas a evitar o reducir al mínimo esa amenaza (…)”.

En consonancia con la referida normativa vigente en el país, la Corte Interamericana de Derechos Humanos también se refirió al principio precautorio en la OC 23/17 del 15 de noviembre de 2017:

“180. (…) Por tanto, esta Corte entiende que, los Estados deben actuar conforme al principio de precaución, a efectos de la protección del derecho a la vida y a la integridad personal, en casos donde haya indicadores plausibles que una actividad podría acarrear daños graves e irreversibles al medio ambiente, aún en ausencia de certeza científica. Por tanto, los Estados deben actuar con la debida cautela para prevenir el posible daño. En efecto, en el contexto de la protección de los derechos a la vida y a la integridad personal, la Corte considera que los Estados deben actuar conforme al principio de precaución, por lo cual, aún en ausencia de certeza científica, deben adoptar las medidas que sean “eficaces” para prevenir un daño grave o irreversible” Posterior a tal resolución y por medio de una sentencia, en Comunidades Indígenas miembros de la Asociación lhaka Honhat (nuestra tierra) vs. Argentina, la Corte IDEH se pronunció el 6 de febrero de 2020 de esta forma: “el derecho a un medio ambiente sano “debe considerarse incluido entre los derechos [...] protegidos por el artículo 26 de la Convención Americana”, dada la obligación de los Estados de alcanzar el “desarrollo integral” de sus pueblos, que surge de los artículos 30, 31, 33 y 34 de la Carta”.

De alta significación, se debe subrayar que, en este pronunciamiento, la Corte IDH remite a la opinión consultiva nro. OC-23/17 con la finalidad de desarrollar el contenido y alcance de tal derecho, merced a lo cual las consideraciones jurídicas de la última lógicamente han venido a alcanzar la obligatoriedad jurídica propia de una sentencia. En tal sentido, el órgano jurisdiccional internacional reitera “que el derecho a un medio ambiente sano “constituye un interés universal” y “es un derecho fundamental para la existencia de la humanidad”, y que “como derecho autónomo [...] protege los componentes del [...] ambiente, tales como bosques, mares, ríos y otros, como intereses jurídicos en sí mismos, aun en ausencia de certeza o evidencia sobre el riesgo a las personas individuales. Se trata de proteger la naturaleza”, no solo por su “utilidad” o “efectos” respecto de los seres humanos, “sino por su importancia para los demás organismos vivos con quienes se comparte el planeta”.

Lo anterior no obsta, desde luego, a que otros derechos humanos puedan ser vulnerados como consecuencia de daños ambientales”. Precisamente, en el desarrollo de la conceptualización del derecho al ambiente, la Corte IDH con toda claridad detalla las obligaciones estatales frente a posibles daños al ambiente, tales como el deber de prevención, el principio de precaución, la obligación de cooperación y el acceso a la información.

En suma, la aplicación del principio precautorio implica que cuando existan indicadores de que cierta actividad plausiblemente podría ocasionar daños graves e irreversibles al ambiente, la falta de certeza o evidencia científica absoluta al respecto no exime de la obligación de adoptar todas aquellas medidas eficientes y eficaces para impedir una vulneración al ambiente.

Concerniente al principio preventivo, en el primer informe de la ONU sobre el estado del derecho ambiental internacional, documento A/73/419 de 30 de noviembre de 2018 elaborado por su secretario general en cumplimiento de la resolución de la asamblea general de 10 de mayo de 2018 (nro. A/72/L.51), se le conceptualiza como pauta normativa del derecho internacional consuetudinario “confirmada por la práctica pertinente en muchos tratados relativos al medio ambiente y los principales proyectos de codificación”.

Ahora, si bien en el informe antedicho se subraya la prevención del daño transfronterizo, lo cierto es que este principio general de derecho, como bien se consigna en el documento ‘95 Principios Jurídicos Medioambientales para un Desarrollo Ecológicamente Sustentable’ (aprobados en la XIX Edición de la Cumbre Judicial Iberoamericana‑2018 y por la Corte Plena en el artículo XIX de la sesión nro. 28-2020 del 25 de mayo de 2020) , tiene un alcance mucho mayor, toda vez que, como guía hermenéutica, conduce a que “las causas y las fuentes de los problemas ambientales se atenderán en forma prioritaria e integrada, tratando de prevenir los efectos negativos que sobre el ambiente se puedan producir. El criterio de prevención prevalecerá entonces, sobre cualquier otro en la gestión pública y privada del medio ambiente y los recursos naturales”. Lo anterior tiene todo sentido, pues es consecuente con el deber de prevenir la consumación de un daño ambiental, y no limitarse a decidir acerca de la reparación de las consecuencias perjudiciales ya corroboradas, incluso disponiendo la paralización de los efectos dañinos.

Tal instituto se refleja, entre otras normas, en los ordinales 194.1 de la Convención de las Naciones Unidas sobre el Derecho del Mar (ratificada por Costa Rica mediante ley nro. 7291) y 5 y Anexo II del Acuerdo de las Naciones Unidas sobre Peces Transzonales y Altamente Migratorios (ratificado mediante ley nro. 8059), así como en la jurisprudencia constitucional (ver sentencias nros. 2021024807 de las 9:20 horas del 5 de noviembre de 2021 y 2018016383 de las 17:00 horas del 28 de setiembre de 2018, entre muchas otras) y en la convencional, verbigracia, e la opinión consultiva nro. OC-23/17 de 15 de noviembre de 2017, párrafos: 127 a 174 e incisos a) y b) del párrafo 242 y la sentencia de 24 de noviembre de 2022 Nombre03 vs. Chile. Justamente, en la última señala la Corte IDH de manera expresa:

“208. Sin perjuicio de lo anterior, en materia específica ambiental, debe destacarse que el principio de prevención de daños ambientales, forma parte del derecho internacional consuetudinario, y entraña la obligación de los Estados de llevar adelante las medidas que sean necesarias ex ante la producción del daño ambiental, teniendo en consideración que, debido a sus particularidades, frecuentemente no será posible, luego de producido tal daño, restaurar la situación antes existente. En virtud del deber de prevención, la Corte ha señalado que “los Estados están obligados a usar todos los medios a su alcance con el fin de evitar que las actividades que se lleven a cabo bajo su jurisdicción, causen daños significativos al […] ambiente”200. Esta obligación debe cumplirse bajo un estándar de debida diligencia, la cual debe ser apropiada y proporcional al grado de riesgo de daño ambiental201. Por otro lado, si bien no es posible realizar una enumeración detallada de todas las medidas que podrían tomar los Estados con el fin de cumplir este deber, pueden señalarse algunas, relativas a actividades potencialmente dañosas: i) regular; ii) supervisar y fiscalizar; iii) requerir y aprobar estudios de impacto ambiental; iv) establecer planes de contingencia, y v) mitigar en casos de ocurrencia de daño ambiental202”.

Por su parte, el principio in dubio pro natura significa, según la ‘Declaración Mundial de la Unión Internacional para la Conservación de la Naturaleza (UICN) acerca del Estado de Derecho en materia ambiental’ que “en caso de duda, todos los procesos ante tribunales, órganos administrativos y otros tomadores de decisión deberán ser resueltos de manera tal que favorezcan la protección y conservación del medio ambiente, dando preferencia a las alternativas menos perjudiciales. No se emprenderán acciones cuando sus potenciales efectos adversos sean desproporcionados o excesivos en relación con los beneficios derivados de los mismos” (ver principio V).

En tal sentido, según el documento ‘95 Principios Jurídicos Medioambientales para un Desarrollo Ecológicamente Sustentable’ (aprobados en la XIX Edición de la Cumbre Judicial Iberoamericana‑2018 y por la Corte Plena en el artículo XIX de la sesión nro. 28-2020 del 25 de mayo de 2020), “Todo operador de las normas ambientales deberá tener siempre presente el principio pro naturaleza, conforme al cual se evitarán los riesgos, se privilegiarán los intereses colectivos generales sobre los particulares, se favorecerá la preservación del medio ambiente y en caso de duda se preferirá la interpretación que en forma más amplia proteja el entorno”.

El principio in dubio pro natura, entonces, no depende de que haya peligro de daño grave o irreversible -como sucede con el principio precautorio‑, sino que implica una “regla general de comportamiento, para la relación del Estado -y la sociedad en general- con el medio ambiente, aplicable a todos los ámbitos de decisiones en que exista un riesgo de afectación al medio ambiente, y que nos obliga a evitar optar por aquellas conductas que puedan causar daño al medio ambiente, cuando existan otras opciones” (Olivares y Lucero, 2018).

Por otra parte, en la sentencia nro. 2012013367 de las 11:33 horas del 21 de setiembre de 2012, este Tribunal Constitucional se refirió a los principios de progresividad y de no regresión en materia ambiental en este sentido:

“V. Sobre los principios de progresividad y no regresión de la protección ambiental. El principio de progresividad de los derechos humanos ha sido reconocido por el Derecho Internacional de los Derechos Humanos; entre otros instrumentos internacionales, se encuentra recogido en los artículos 2 del Pacto Internacional de Derechos Económicos Sociales y Culturales, artículo 1 y 26 de la Convención Americana sobre Derechos Humanos y artículo 1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales. Al amparo de los estas normas, el Estado asume la obligación de ir aumentando, en la medida de sus posibilidades y desarrollo, los niveles de protección de los derechos humanos, de especial consideración aquellos, que como el derecho al ambiente (art. 11 del Protocolo), requieren de múltiples acciones positivas del Estado para su protección y pleno goce por todos sus titulares.

Del principio de progresividad de los derechos humanos y del principio de irretroactividad de las normas en perjuicio de derechos adquiridos y situaciones jurídicas consolidadas, recogido en el numeral 34 de la Carta Magna, se deriva el principio de no regresividad o de irreversibilidad de los beneficios o protección alcanzada. El principio se erige como garantía sustantiva de los derechos, en este caso, del derecho a un ambiente sano y ecológicamente equilibrado, en virtud del cual el Estado se ve obligado a no adoptar medidas, políticas, ni aprobar normas jurídicas que empeoren, sin justificación razonable y proporcionada, la situación de los derechos alcanzada hasta entonces. Este principio no supone una irreversibilidad absoluta pues todos los Estados viven situaciones nacionales, de naturaleza económica, política, social o por causa de la naturaleza, que impactan negativamente en los logros alcanzados hasta entonces y obliga a replantearse a la baja el nuevo nivel de protección.

En esos casos, el Derecho a la Constitución y los principios bajo examen obligan a justificar, a la luz de los parámetros constitucionales de razonabilidad y proporcionalidad, la reducción de los niveles de protección. En este sentido, la Sala Constitucional ha expresado en su jurisprudencia, a propósito del derecho a la salud: “…conforme al PRINCIPIO DE NO REGRESIVIDAD, está prohibido tomar medidas que disminuyan la protección de derechos fundamentales. Así entonces, si el Estado costarricense, en aras de proteger el derecho a la salud y el derecho a la vida, tiene una política de apertura al acceso a los medicamentos, no puede -y mucho menos por medio de un Tratado Internacional- reducir tal acceso y hacerlo más restringido, bajo la excusa de proteger al comercio. (Sentencia de la Sala Constitucional Nº 9469-07). En relación con el derecho al ambiente dijo: “Lo anterior constituye una interpretación evolutiva en la tutela del ambiente conforme al Derecho de la Constitución, que no admite una regresión en su perjuicio.” (Sentencia de la Sala Constitucional Nº 18702-10)”. (Lo destacado no corresponde al original). (En el mismo sentido, las sentencias 2014-012887, 2017-002375, 2017-005994, 2019-012745 y 2019-017397)”.

De este modo, de acuerdo con el principio de progresividad, el Estado asume la obligación de aumentar, en la medida de lo posible, los niveles de protección de los derechos humanos, incluido el derecho al ambiente sano y ecológicamente equilibrado. Por su parte, la aplicación del principio de no regresión consiste en una garantía que constriñe al Estado a abstenerse de adoptar medidas, políticas o normas que empeoren, sin una justificación razonable y proporcionada, el grado de protección a los derechos fundamentales ya alcanzado, y que, dado el caso, se tienen que ponderar las medidas de compensación que correspondan.

Finalmente, este Tribunal explicó el principio de objetivación de la tutela ambiental en estos términos:

“En cuanto al ambiente, objeto del derecho fundamental expuesto, nuestra Carta Magna exige además que sea “sano”. La exigencia “sano” nos conduce a la “capacidad regenerativa” y a la “capacidad de sucesión” para garantizar la vida. De ambos requisitos: “sano” y equilibrado” se desprende la necesidad de un desarrollo sostenible y sustentable; la calidad de vida y la calidad ambiental dependen de ello. Ahora bien, con los conceptos de “ambiente”, “sano” “ecológicamente equilibrado”, la norma constitucional introdujo la ciencia y la técnica en las decisiones ambientales, sean estas legislativas o administrativas, de tal manera que, en los términos de los ordinales 16 de la Ley General de la Administración Pública y 38 de la Ley Orgánica del Ambiente, las actuaciones estatales en materia ambiental deben fundarse y no pueden contradecir las reglas unívocas de la ciencia y la técnica en aras de lograr el goce pleno y universal a un ambiente sano y ecológicamente equilibrado y, además, un “mayor bienestar para todos los habitantes del país”.

En cuanto al sometimiento de las decisiones legislativas y administrativas a las reglas unívocas de la ciencia y la técnica, la Sala lo ha denominado principio de objetivación de la tutela ambiental: “De la objetivación de la tutela ambiental (…) es un principio que en modo alguno puede confundirse con el anterior [principio precautorio o “principio de la evitación prudente”], en tanto, como derivado de lo dispuesto en los artículos 16 y 160 de la Ley General de la Administración Pública, se traduce en la necesidad de acreditar con estudios técnicos la toma de decisiones en esta materia, tanto en relación con actos como de las disposiciones de carácter general –tanto legales como reglamentarias–, de donde se deriva la exigencia de la vinculación a la ciencia y a la técnica con lo cual, se condiciona la discrecionalidad de la Administración en esta materia. De manera que en atención a los resultados que se deriven de esos estudios técnicos –tales como los estudios de impacto ambiental–, si se evidencia un criterio técnico objetivo que denote la probabilidad de un evidente daño al ambiente, los recursos naturales o a la salud de las personas, es que resulta obligado desechar el proyecto, obra o actividad propuestas; y en caso de una "duda razonable" resulta obligado tomar decisiones en pro del ambiente (principio pro-natura), que puede traducirse en la adopción, tanto de medidas compensatorias como precautorias, a fin de proteger de la manera adecuada el ambiente.” (Sentencia de la Sala Constitucional Nos. 21258-10, 17126-06, 14293-05)” (el resaltado fue agregado). (Resolución nro. 2012-13367 de las 11:33 horas del 21 de setiembre de 2012).

VI.Sobre el caso concreto. En el sub lite, la parte accionante indica que hace unos años adquirió un terreno en la zona aledaña y limítrofe a la Laguna de Carrizal, en el sector de Bajamar, en Garabito de Puntarenas, la cual es un humedal reconocido que forma parte del corredor biológico Paso Las Lapas. Aduce que en esa zona se iniciaron acciones de invasión a la zona protegida de la laguna en una calle sin salida que termina en el límite de esta, abrieron un acceso no autorizado y comenzaron con labores de eliminación tanto de la capa vegetal como de la flora y fauna; además realizaron movimientos de tierra y quemas no controladas. Relata que a finales de octubre de 2023 denunció lo acontecido ante las autoridades recurridas, además no solo evidenció la invasión y los daños ambientales producidos, sino que también solicitó que se ejecuten acciones al respecto. Sostiene que, desde ese momento, las acciones de invasión y afectaciones han sido mayores, lo cual fue ampliado en las respectivas denuncias.

Acusa que no ha obtenido respuesta de la municipalidad. Acota que el Sitada del Minae, mediante correo electrónico de 22 de enero de 2024, le comunicó que habían constatado tanto las invasiones como las afectaciones ambientales; además, que se limitaron a formular la denuncia ante la fiscalía de Garabito. Refiere que ante esa respuesta solicitó que le indicaran por qué no tomaban alguna acción cautelar en vía administrativa, tal como eliminar el acceso indebido abierto por los invasores; sin embargo, no ha habido respuesta ni acciones de control. Alega que ha advertido ante la municipalidad recurrida labores de movimientos de tierras y de construcción en el área protegida de la laguna, así como ha pedido información y acciones desde la perspectiva de las normas, construcciones y fraccionamientos; no obstante, tampoco le han contestado. Explica que la inacción de las autoridades recurridas ha permitido que los invasores se adueñen más de la zona.

Asevera que entre el 24 y 26 de enero de 2024 se eliminó prácticamente tanto la capa vegetal como la flora y fauna que quedaba. Pide que se declare con lugar el recurso y que, como medida cautelar, se ordene a las autoridades accionadas detener las obras y bloquear el acceso.

Del estudio de los autos, con respecto al Sinac, se tiene por demostrado, que el 25 octubre de 2023 se planteó a través del Sitada de la Contraloría Ambiental del Minae, una denuncia a Nombre01 del tutelado dirigida a “Señores Sistema Nacional de Áreas de Conservación (SINAC) MINISTERIO DEL AMBIENTE Y ENERGÍA (MINAE) Presente Señores Sistema de Área de Conservación Pacífico Central (ACOPAC) Sistema Nacional de Áreas de Conservación (SINAC) MINISTERIO DEL AMBIENTE Y ENERGÍA (MINAE) (…)” con el siguiente contenido: “(…) me Presento a efecto de Realizar la Presente DENUNCIA, en cuanto a Muy Posibles situaciones de “Afectación” en cuanto al HUMEDAL DE LA LAGUNA CARRIZAL. Y a los efectos de mi Presente Gestión, Realizo las Siguientes Consideraciones: ACLARACIÓN PRIMARIA: Esta Gestión de Dirige a Todas sus Autoridades (Administrativas), en Rigo de las obligaciones, Deberes, Responsabilidades y Competencias que por Ley (sentido laxo), Presentan a efecto de Intervenir y de Tomar Acciones de Control, Protección y Sanción en cuanto a la Relevante Temática Ambiental que Entraña esta Denuncia.

Teniéndose que en Mérito de la misma, Todas y Cada una de esas Dependencias Destinatarias, ante las que se Gestiona, presentan Obligación de Proceder (Arts. 11, 27, 30, 41, 50 y 129 de la Constitución Política). SOBRE EL HUMEDAL EN CUESTIÓN: Por lo que hemos Podido Verificar, la LAGUNA DE CARRIZAL es efectivamente un Humedal Reconocido, el cual Forma Parte de el Corredor Biológico Paso las lapas. Se Ubica en el Distrito de Tárcoles, Cantón de Garabito, Provincia de Puntarenas. Hoja Cartográfica BARRANCA. Latitud: 9º 50´13” y Longitud 64º 40’ 40”. (…) EN CUANTO A LA PERSPECTIVA DE MI DENUNCIA: Como ya dije, pese a ser Comerciante en San José, desde hace Varios Años Soy Dueño/Usufructuario debido de un Terreno en la Zona de Carrizal. Mismo que en su Lindero Oeste Colinda con la Zona de la Laguna de Carrizal. El acceso a mi Propiedad se da por era una Calle sin Salida, la cual TOPA CON EL REFERIDO HUMEDAL, SIN DAR NINGÚN ACCESO AL MISMO.

(…) Primeramente, hace unas Semanas, un Grupo de Personas cuya identidad Desconozco, Vino y Realizó una Construcción de un PORTÓN DE ACCESO A LA ZONA DE HUMEDAL, AL FINAL DE LA CALLE SIN SALIDA ANTES ALUDIDA. Luego, estas mismas Personas han Iniciado a Realizar Quemas en la Zona del Humedal. MISMAS QUE NO SÉ EN CUANTO AFECTA ESTA ZONA PROTEGIDA. Y Hace unos Días, los Señores en cuestión, me han Contactado para Ofrecerme VENDER y/o Urbanizar la Zona Posterior o Trase a mi Propiedad, la cual Yo Tengo Identificada como Parte del Humedal de la Laguna Carrizal. Siendo tales Hechos Evidentes de un Posicionamiento y Potencial Desarrollo Urbanístico en la Zona del Humedal Referido. Y Siendo ello lo que me Lleva a Acudir a sus Autoridades, como Necesarias y/o Potenciales Intervinientes, en cuanto a Alguna Situación Relacionada con la Zona Protegida dicha. (…) PETICIÓN DE CURSO, INVESTIGACIÓN E INFORMACIÓN: 1.

Dado lo que se Informa y Denuncia por este medio a Todas sus Autoridades, SE LES PONE ASÍ EN CONOCIMIENTO, a Todos los Efectos de Ley y de Rigor, en cuenta sus Responsabilidades por Omisión o Incumplimiento de sus Funciones, Atribuciones y Deberes (Potencial Culpa Grave y/o Negligencia). Esto en caso de Permitirse o Tolerarse por Omisión, la Potencial Invasión y/o Afectación del Humedal sobre el cual Versa esta Denuncia. 2- En cuanto a las Autoridades del MINAE a las que se Cursa esta Denuncia, se Requieren Todas sus Acciones de investigación, Control, Resguardo y Sanción en cuanto lo de Denuncia y en cuanto a la Efectiva Protección del humedal sobre el cual Versa esta Denuncia. Y que se investiguen y Accionen en cuanto a la Apertura de un Acceso indebido (Portón) al Humedal aludido. (…) Y EN RELACIÓN CON TODOS LOS DESTINATARIOS DE ESTA DENUNCIA, EL SUSCRITO SE TORNA EN INTERESADO DIRECTO Y PIDE QUE SE NOS BRINDE RESPUESTA E INFORMACIÓN SOBRE LAS ACCIONE QUE SEAN TOMADAS POR ESAS DEPENDENCIAS ESTO DENTRO DE LOS TÉRMINOS DE LEY.

QUEDANDO EN ESPERA DE UNA RESPUESTA DEBIDA Y EFECTIVA (ARTS. 27, 30 Y 41 DE LA CONSTITUCIÓN POLÍTICA). NOTIFICACIONES: Las Atenderé al Correo Electrónico de mi Abogado. Lic. Mario Quesada Aguirre. [...]. San José, 24 de Octubre del 2023” (sic). A la queja del accionante ingresada en el Sitada se le asignó el registro nro. 43570-2023. El Acopac, mediante acta de inspección ocular de las 8:41 horas de 22 de noviembre de 2023, hizo constar: “Se realiza inspección para atender denuncia ingresada en Sitada relacionada con invasión del area (sic) de protección de la Laguna Carrizal, la denuncia menciona la colocación de un portón de acceso a la Laguna, en esta inspección se comprueba lo denunciado, se toman coordenadas, mediciones así como fotografías, ademas (sic) se localiza la realización de un camino paralelo a la laguna realizado presuntamente con maquinaria, lo localizado en el area (sic) de protección de la laguna corresponde a un portón de madera y metal de color negro con 5 metros de ancho por 1.40 m de alto una pared de cemento y cerámica junto al portón de 2.28 m de acho por 1.61 m de alto además una cerca de alambre de púa de 9 m de ancho perpendicular al borde de la laguna, el camino que se encuentra junto al portón y que va en dirección este tiene una medida de 60 m de largo por 4.30 m de ancho.

Es todo ” El 22 de enero de 2024, la encargada del Programa Prevención, Protección y Control del Enlace Programa Vida Silvestre de la Oficina Subregional de Orotina del Acopac del Sinac, comunicó al correo electrónico [...], lo siguiente: “Por este medio le informo que con relación a la queja ingresada en SITADA con el número de registro 43570-2023 la misma fue atendida (ver el acta de inspección ocular ingresada en la plataforma), y el informe fue presentado en la Fiscalía de Garabito el día jueves 18 de enero de 2024 con el número de informe SINAC-ACOPAC-OSRO-PPC-223-2023. El número de expediente judicial no lo tenemos pues la Fiscalía de Garabito no nos da el numero (sic) en el momento que se entrega el mismo. Considero importante además mencionarle que sobre el caso en cuestión se presentó una denuncia en la misma Fiscalía en el año 2021 en atención a la queja SITADA 25424-2021 por medio del informe SINAC-ACOPAC-DRFVS-055-2021 suscrito por el funcionario Gil Ruiz expediente judicial [Valor 006].

Además en el año 2022 se presentó el informe policial SINAC-ACOPAC-OSRO-551-2022 suscrito por mi persona como ampliación al expediente judicial [Valor 002]. Así mismo en ese mismo año el funcionario Adrian (sic) Arce suscribió el informe SINAC-ACOPAC-PINV-005-2022. Todos los informes relacionados con afectaciones realizados por quemas tanto en los alrededores de la Laguna Carrizal como en sectores que se encontraban a Nombre01 de la Asociación de vecinos de Bajamar. Finalmente informarle que a la fecha se desconoce el estado de dicha causa o causas”. La encargada del Programa de Prevención, Protección y Control de la oficina Subregional Orotina del Área de Conservación Pacífico Central, en el oficio SINAC-ACOPAC-OSRO-PPC-020-2024 del 1º de febrero de 2024, consignó: “La queja fue atendida el día 22 de noviembre de 2023, cuya acta de inspección ocular se ingresó en la plataforma SITADA el mismo día, posteriormente el informe fue presentado en la Fiscalía de Garabito el día jueves 18 de enero de 2024 con el número de informe SINAC-ACOPAC-OSRO-PPC-223-2023.

A la fecha no se cuenta con el número de expediente judicial pues la Fiscalia (sic) de Garabito no nos da el numero en el momento que se entrega el mismo, y en consecuencia no se ha adjuntado dicho informe para seguimiento de la Asesoría Legal en la plataforma. Sobre el caso de la Laguna Carrizal además de la presente queja, se han atendido otras quejas siendo que se presentó una denuncia en la misma Fiscalia (sic) en el año 2021 en atención a la queja SITADA 25424-2021 por medio del informe SINAC-ACOPAC-DRFVS-055-2021 suscrito por el funcionario Gil Ruiz expediente judicial [Valor 007]. Además en el año 2022 se presentó el informe policial SINAC-ACOPAC-OSRO-551-2022 suscrito por mi persona como ampliación al expediente judicial [Valor 002]. Así mismo en el año 2021 el funcionario Adrian (sic) Arce suscribió el informe SINAC-ACOPAC-PINV-005-2022. Todos los informes son relacionados con afectaciones realizadas por quemas tanto en los alrededores de la Laguna Carrizal como en sectores que se encontraban a Nombre01 de la Asociación de vecinos de Bajamar.

Por otro lado, es importante mencionar que, si bien la Laguna Carrizal se encuentra en un area (sic) aledaña a la costa, la misma se encuentra dentro de propiedad privada inscrita con el número de matrícula a mbre01 d de ASOCIACION (sic) DE LA COMUNIDAD DE BAJAMAR CEDULA (sic) JURIDICA (sic) 3-002-320413. Adicionalmente sobre los hechos denunciados no se ha tenido indicios o información de testigos para poder identificar a la persona o personas imputadas”. El oficio SINAC-ACOPAC-OSRO-PPC-223-2023 de 29 de diciembre de 2023 dirigido a la Fiscalía de Garabito, señala: “ASUNTO: Informe por daños al ambiente Estimados señores: Quien suscribe, Stephanie Paola Alvarado Ledezma (…) Funcionaria del Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, actuando en calidad de autoridad de policía, según el artículo 54 de la Ley Forestal y artículo 16 de la Ley de Vida Silvestre, destacada jurisprudencialmente en la Oficinal Sub Regional de Orotina, me presento ante su autoridad con la finalidad de informar los siguientes hechos en contra de los Recursos Naturales que se detallan a continuación: 1.

HECHOS PRIMERO: Mediante el Sistema Integrado de Tramite (sic) de Denuncias Ambientales (SITADA) se recibió una denuncia la cual contiene un escrito adjunto, que menciona la afectación al humedal Laguna Carrizal, ubicada en Bajamar, Tárcoles, Garabito. SEGUNDO: Por lo que el día 22 de noviembre de 2023 a las 08:40 horas se procedió a atender la queja en compañía de funcionarios de la Unidad Ambiental del Servicio Nacional de Guardacostas de la Estación de Caldera. TERCERO: En el sitio, que se ubica al costado Norte de la Laguna Carrizal se localiza un portón de madera y metal de color negro con 5 metros de ancho por 1.40 m de alto, junto al portón se ubica una pared de cemento y cerámica de 2.28 m de ancho por 1.61 m de alto. CUARTO: Además se localiza una cerca de alambre de púa de 9 m de largo, que se ubica perpendicular al borde la laguna. QUINTO: Además se localiza la apertura de un camino aparentemente realizado con maquinaria, el mismo inicia junto al portón descrito anteriormente, y se encuentra paralelo al borde de la laguna, tiene una medida de 60 m de largo por 4.30 de ancho.

SEXTO: Lo localizado en esta inspección se encuentra dentro del area (sic) de protección de la Laguna Carrizal (50 m) como se puede observar en la figura 1. SETIMO (sic): Que según la verificación de coordenadas por medio del programa Quantum GIS y según la información que consta en las capas de información del Registro Inmobiliario del SNIT (Sistema Nacional de Información Territorial) del Registro Nacional, el inmueble donde se realizó el camino se encuentra inscrito con el número de finca Dirección01 a mbre01 d de [Nombre 003] Cedula (sic) identidad [CED02], [Nombre 004] Cedula (sic) identidad [CED03], [Nombre 005] Cedula (sic) identidad [Valor 010], [mbre01 0 006] (sic) Cedula (sic) identidad [Valor 011]. OCTAVO: Por otro lado, el portón se ubica en un area (sic) donde finaliza un camino público, lo anterior de acuerdo a (sic) la capa de información de vías públicas. NOVENO: En esta inspección no solamente se detecta lo que informa el señor [mbre01 0 001], sino que también se detecta que la propiedad que colinda con los hechos denunciados posee una tapia de cemente la cual contiene 96 m dentro del área de protección de la Laguna Carrizal, además de que hay dos edificaciones dentro del area (sic) de protección.

Lo anterior fue posible observarlo en la revisión de coordenadas y utilizando la imagen de Google Satélite, pues en el campo al estar cerrada la propiedad no se podía observar claramente. DECIMO (sic): La tapia así como las dos edificaciones se encuentran en la propiedad con numero (sic) de finca matrícula , a re01 de de [re01 007 007] (sic) Cedula (sic) identidad [Valor 6], [], [re01 008 008] Cedula (sic) identidad [Valor 7]”. ]”.

Por otra parte, en cuanto a la Municipalidad de Garabito, se comprobó que, en octubre de 2023 recibió una denuncia a Nombre01 del tutelado dirigida a “ Señor Alcalde Municipal y Miembros del Consejo (sic) Municipal MUNICIPALIDAD DE GARABITO Presente Señores Unidades de Servicios Técnicos y Servicios Ambientales MUNICIPALIDAD DE GARABITO (…)” con el siguiente contenido: “(…) me Presento a efecto de Realizar la Presente DENUNCIA, en cuanto a Muy Posibles situaciones de “Afectación” en cuanto al HUMEDAL DE LA LAGUNA CARRIZAL. Y a los efectos de mi Presente Gestión, Realizo las Siguientes Consideraciones: ACLARACIÓN PRIMARIA: Esta Gestión de Dirige a Todas sus Autoridades (Administrativas), en Rigo de las obligaciones, Deberes, Responsabilidades y Competencias que por Ley (sentido laxo), Presentan a efecto de Intervenir y de Tomar Acciones de Control, Protección y Sanción en cuanto a la Relevante Temática Ambiental que Entraña esta Denuncia.

Teniéndose que en Mérito de la misma, Todas y Cada una de esas Dependencias Destinatarias, ante las que se Gestiona, presentan Obligación de Proceder (Arts. 11, 27, 30, 41, 50 y 129 de la Constitución Política). SOBRE EL HUMEDAL EN CUESTIÓN: Por lo que hemos Podido Verificar, la LAGUNA DE CARRIZAL es efectivamente un Humedal Reconocido, el cual Forma Parte de el Corredor Biológico Paso las lapas. Se Ubica en el Distrito de Tárcoles, Cantón de Garabito, Provincia de Puntarenas. Hoja Cartográfica BARRANCA. Latitud: 9º 50´13” y Longitud 64º 40’ 40”. (…) EN CUANTO A LA PERSPECTIVA DE MI DENUNCIA: Como ya dije, pese a ser Comerciante en San José, desde hace Varios Años Soy Dueño/Usufructuario debido de un Terreno en la Zona de Carrizal. Mismo que en su Lindero Oeste Colinda con la Zona de la Laguna de Carrizal. El acceso a mi Propiedad se da por era una Calle sin Salida, la cual TOPA CON EL REFERIDO HUMEDAL, SIN DAR NINGÚN ACCESO AL MISMO.

(…) Primeramente, hace unas Semanas, un Grupo de Personas cuya identidad Desconozco, Vino y Realizó una Construcción de un PORTÓN DE ACCESO A LA ZONA DE HUMEDAL, AL FINAL DE LA CALLE SIN SALIDA ANTES ALUDIDA. Luego, estas mismas Personas han Iniciado a Realizar Quemas en la Zona del Humedal. MISMAS QUE NO SÉ EN CUANTO AFECTA ESTA ZONA PROTEGIDA. Y Hace unos Días, los Señores en cuestión, me han Contactado para Ofrecerme VENDER y/o Urbanizar la Zona Posterior o Trase a mi Propiedad, la cual Yo Tengo Identificada como Parte del Humedal de la Laguna Carrizal. Siendo tales Hechos Evidentes de un Posicionamiento y Potencial Desarrollo Urbanístico en la Zona del Humedal Referido. Y Siendo ello lo que me Lleva a Acudir a sus Autoridades, como Necesarias y/o Potenciales Intervinientes, en cuanto a Alguna Situación Relacionada con la Zona Protegida dicha. (…) PETICIÓN DE CURSO, INVESTIGACIÓN E INFORMACIÓN: 1.

Dado lo que se Informa y Denuncia por este medio a Todas sus Autoridades, SE LES PONE ASÍ EN CONOCIMIENTO, a Todos los Efectos de Ley y de Rigor, en cuenta sus Responsabilidades por Omisión o Incumplimiento de sus Funciones, Atribuciones y Deberes (Potencial Culpa Grave y/o Negligencia). Esto en caso de Permitirse o Tolerarse por Omisión, la Potencial Invasión y/o Afectación del Humedal sobre el cual Versa esta Denuncia. (…) 3.- En cuanto a las Autoridades de la Municipalidad de Garabito a las que se Cursa esta Denuncia, también se les Requieren Todas sus Acciones de Investigación, Control y Sanción en cuanto lo de Denuncia y en cuanto a la Efectiva Protección del Humedal sobre el cual Versa esta Denuncia. Así como se les previene a Efecto de que NO OTORGUEN Ningún Permiso de Loteo, Fraccionamiento, Construcción y/o Urbanización en la Zona de Humedal Señalado y Claramente Localizado. Y que Investiguen y Accionante en cuanto a la Apertura de un Acceso Indebido (Portón) al Humedal aludido.

Y EN RELACIÓN CON TODOS LOS DESTINATARIOS DE ESTA DENUNCIA, EL SUSCRITO SE TORNA EN INTERESADO DIRECTO Y PIDE QUE SE NOS BRINDE RESPUESTA E INFORMACIÓN SOBRE LAS ACCIONE QUE SEAN TOMADAS POR ESAS DEPENDENCIAS ESTO DENTRO DE LOS TÉRMINOS DE LEY. QUEDANDO EN ESPERA DE UNA RESPUESTA DEBIDA Y EFECTIVA (ARTS. 27, 30 Y 41 DE LA CONSTITUCIÓN POLÍTICA). NOTIFICACIONES: Las Atenderé al Correo Electrónico de mi Abogado. Lic. Mario Quesada Aguirre. [...]. San José, 24 de Octubre del 2023”. El coordinador a.i. y la analista de procesos superiores a.i, ambos de Servicios Ambientales y Municipales de la Municipalidad de Garabito, mediante oficio SAM-477-2023 de 31 de octubre de 2023 dirigido a “Tobías Murillo Rodríguez Alcalde Municipal Municipalidad de Garabito”, señalaron: “Con respecto a la solicitud realizada mediante el Oficio AMI-2237-2023-TM en relación con la boleta de documentos varios 41648-41647.

“Les remito copia de boleta de documentos varios 41648-41647, suscrito por el señor [Nombre01 002] (sic) [Nombre01 001], donde remite formal denuncia por afectación al humedal de laguna Carriza, para que, en un plazo de 10 días hábiles, realicen un informe al respecto y comunique al administrad.” A partir de ello, se le informa que la denuncia fue ingresada al Sistema Integrado de Trámite de Denuncias Ambientales (SITADA) administrado por la Contraloría Ambiental y en el cual la Municipalidad de Garabito tiene un usuario. Cabe destacar que la denuncia se identifica con código 43570-2023 y fue asignada por la Contraloría Ambiental al Sistema Nacional de Áreas de Conservación del Área de Conservación Pacífico Central (SINAC-ACOPAC), ya que es la dependencia del MINAE con las competencias para la atención de denuncias relacionadas al tema de humedales. Esto debido a que cuenta con expertos en la materia a diferencia de la Municipalidad de Garabito.

Por tanto, el SINAC procederá a realizar la respectiva investigación y según se requiere el Departamento de Servicios Ambientales y Municipales le brindará el apoyo necesario desde sus competencias para la atención del caso (…)”. El coordinador a.i. y la analista de procesos superiores a.i, ambos de Servicios Ambientales y Municipales de la Municipalidad de Garabito, mediante oficio SAM-046-2024 de 6 de febrero de 2024 dirigido a “Señores (as) Gestión Jurídica Municipalidad de Garabito”, expusieron: “Por medio de la presente se les informa sobre lo actuado por el departamento de Servicios Ambientales y Municipales en relación a la denuncia realizada por el señor [Nombre01 001]: • El día 31 de octubre del 2023, mediante el oficio SAM-477-2023 se dio respuesta a la solicitud presentada en el oficio AMI-2297-2023›TM al correo electrónico ...01. En la que se le informa que la denuncia fue ingresada al Sistema Integrado de Trámite y Atención de Denuncias Ambientales (SITADA) y le fue asignada al Sistema Nacional de Áreas de Conservación (SINAC) para su atención. • El día 29 de enero del 2024, se dio respuesta a uno de los correos electrónicos provenientes de la dirección [...] desde los correos ...02 y ...03.

Donde se le solicita un número telefónico mediante el cual se pudiese contactar con el fin de brindarle la ayuda correspondiente desde nuestras competencias. • El día 6 de febrero del 2024, se realizó una inspección en el sitio indicado en conjunto con el Lic. Jason Angulo del Departamento de Servicios Técnicos – Zona Marítima Terrestre y la inspectora Vanessa Camacho del Departamento de Seguridad y Convivencia Social. EI inmueble en apariencia corresponde a la finca 0045251, propiedad privada a la que no se ingresó ya que no había personas en el sitio que nos permitieran el ingreso. No obstante, se verificó la existencia de permisos municipales otorgados y no existen. Asimismo, en los registros se encuentra el levantamiento del Acta de clausura 0079-2021 realizada en el año 2021. (…) Se adjunta Oficio SAM-477-2023 y comprobantes de los correos enviados en respuesta”.

Desde este panorama, procede declarar con lugar el recurso, con base en las siguientes consideraciones.

En primer lugar, la Sala observa que la solicitud planteada ante el Sinac expone la afectación al “humedal laguna Carrizal” por el levantamiento de infraestructuras y la realización de quemas, además, solicita la investigación de lo planteado y que se ejecuten acciones de control, resguardo y sanción; empero, tal órgano desconcentrado del Minae solo llevó a cabo una inspección en la zona e interpuso una denuncia ante el Ministerio Público (en la que no se abordaron la totalidad de los extremos alegados en la gestión del recurrente). Nótese que en el “Informe por daños al ambiente” enviado a la fiscalía, se aludió únicamente a construcciones y la apertura de un camino dentro del área de protección de la laguna Carrizal. En todo caso, la actuación del Sinac en sede administrativa no puede limitarse, una vez constatada alguna posible situación de relevancia ambiental, a la remisión del asunto a la fase investigativa en la vía penal. Precisamente, tal dependencia tiene potestad de instaurar los procedimientos sobre denuncias que se formulen por infracciones a la normativa ambiental y emitir actos administrativos para procurar su cumplimiento. De ahí que la omisión en atender el fondo de la situación denunciada constituye un extremo de relevancia constitucional a los efectos de procurar la tutela del numeral 50 constitucional.

En relación con lo anterior, la Ley de Biodiversidad indica:

“ARTÍCULO 22 Sistema Nacional de Áreas de Conservación Créase el Sistema Nacional de Áreas de Conservación, en adelante denominado Sistema, que tendrá personería jurídica propia; será un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integrará las competencias en materia forestal, vida silvestre, áreas protegidas y el Ministerio del Ambiente y Energía, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica. Conforme a lo anterior, la Dirección General de Vida Silvestre, la Administración Forestal del Estado y el Servicio de Parques Nacionales ejercerán sus funciones y competencias como una sola instancia, mediante la estructura administrativa del Sistema, sin perjuicio de los objetivos para los que fueron establecidos. Queda incluida como competencia del Sistema la protección y conservación del uso de cuencas hidrográficas y sistemas hídricos.

(…)

ARTÍCULO 28.- Áreas de Conservación El Sistema estará constituido por unidades territoriales denominadas Áreas de Conservación bajo la supervisión general del Ministerio del Ambiente y Energía, por medio del Consejo Nacional de Áreas de Conservación, con competencia en todo el territorio nacional, según se trate de áreas silvestres protegidas, áreas con alto grado de fragilidad o de áreas privadas de explotación económica. Cada área de conservación es una unidad territorial del país, delimitada administrativamente, regida por una misma estrategia de desarrollo y administración, debidamente coordinada con el resto del sector público. En cada uno se interrelacionan actividades tanto privadas como estatales en materia de conservación sin menoscabo de las áreas protegidas. Las Áreas de Conservación se encargarán de aplicar la legislación vigente en materia de recursos naturales, dentro de su demarcación geográfica.

Deberán ejecutar las políticas, las estrategias y los programas aprobados por el Consejo Nacional de Áreas de Conservación, en materia de áreas protegidas; asimismo, tendrá a su cargo la aplicación de otras leyes que rigen su materia, tales como la Ley de conservación de la vida silvestre, No. 7317, de 30 de octubre de 1992, y la Ley Forestal, No. 7575, de 13 de febrero de 1996, Ley Orgánica, No. 7554, de 4 de octubre de 1995, y la Ley de Creación del Servicio de Parques Nacionales, No. 6084, de 24 de agosto de 1977. Basado en las recomendaciones del Consejo, el Ministerio del Ambiente y Energía definirá la división territorial que técnicamente sea más aconsejable para las Áreas de Conservación del país, así como sus modificaciones”.

Asimismo, la Ley de Conservación de Vida Silvestre señala:

“Artículo 7.- El Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía tiene las siguientes funciones en el ejercicio de su competencia:

  • a)Establecer las medidas técnicas por seguir para el buen manejo, conservación y administración de la vida silvestre(*), objeto de esta ley y de los respectivos convenios y tratados internacionales ratificados por Costa Rica.

(*)(Modificada su denominación por el artículo 3° de la ley N° 9106 del 20 de diciembre del 2012, anteriormente decía "flora y fauna silvestre")

  • b)Establecer los refugios nacionales de vida silvestre y administrarlos.
  • c)Fomentar el establecimiento de los refugios nacionales de vida silvestre en propiedad mixta o privada.
  • d)Promover y ejecutar programas de educación e investigación sobre el uso adicional de los recursos naturales renovables del país, en el campo de la vida silvestre que le competen, de conformidad con esta ley.
  • e)Promover y ejecutar investigaciones en el campo de la vida silvestre, salvo aquellos que se refieran a recursos genéticos y bioquímicos regulados por la Ley de Biodiversidad.
  • f)Extender, denegar o cancelar los permisos de caza de control, extracción, investigación, colecta científica y académica y cualquier permiso para importar o exportar vida silvestre, sus partes, productos y derivados, así como aprobar, rechazar o modificar los planes de manejo y permisos de funcionamiento de los diferentes establecimientos de manejo de vida silvestres, refugio de vida silvestre y para aquellas actividades de manejo de vida silvestre que lo requieran.
  • g)Financiar las tesis o las investigaciones que permitan el mejor conocimiento de la vida silvestre.
  • h)Proteger, supervisar y administrar, con enfoque ecosistémico los humedales, así como determinar su calificación de importancia nacional o internacional.
  • i)Crear y gestionar los programas de manejo, control, vigilancia e investigación sobre la vida silvestre.
  • j)Apoyar los programas de educación formal e informal de la Comisión Interinstitucional para la Educación y la Conciencia Pública e Investigación en Biodiversidad (Ciecopi).
  • k)Coordinar con los otros entes competentes en la prevención, mitigación, atención y seguimiento de los daños a la vida silvestre.
  • l)Promover la participación responsable de las personas, en forma individual o colectiva, en la preservación y restauración del equilibrio ecológico y la protección del ambiente.
  • m)Fomentar la conservación de ecosistemas naturales.
  • n)Establecer planes de contingencia para la protección de la vida silvestre, en caso de desastres naturales.
  • ñ)Coordinar acciones con las instituciones, públicas o privadas, nacionales o internacionales para la conservación y el manejo sostenible de la vida silvestre.

La delimitación de los humedales se hará por decreto ejecutivo, según criterios técnicos.

(Así reformado por el artículo 1 de la ley N° 9106 del 20 de diciembre de 2012)”.

En adición, el numeral 99 de la Ley Orgánica del Ambiente establece:

“Artículo 99.- Sanciones administrativas. Ante la violación de las normativas de protección ambiental o ante conductas dañinas al ambiente claramente establecidas en esta ley, la Administración Pública aplicará las siguientes medidas protectoras y sanciones:

  • a)Advertencia mediante la notificación de que existe un reclamo.
  • b)Amonestación acorde con la gravedad de los hechos violatorios y una vez comprobados.
  • c)Ejecución de la garantía de cumplimiento, otorgada en la evaluación de impacto ambiental.
  • d)Restricciones, parciales o totales, u orden de paralización inmediata de los actos que originan la denuncia.
  • e)Clausura total o parcial, temporal o definitiva, de los actos o hechos que provocan la denuncia.
  • f)Cancelación parcial, total, permanente o temporal, de los permisos, las patentes, los locales o las empresas que provocan la denuncia, el acto o el hecho contaminante o destructivo.
  • g)Imposición de obligaciones compensatorias o estabilizadoras del ambiente o la diversidad biológica.
  • h)Modificación o demolición de construcciones u obras que dañen el ambiente.
  • i)Alternativas de compensación de la sanción, como recibir cursos educativos oficiales en materia ambiental; además, trabajar en obras comunales en el área del ambiente.

Estas sanciones podrán imponerse a particulares o funcionarios públicos, por acciones u omisiones violatorias de las normas de esta ley, de otras disposiciones de protección ambiental o de la diversidad biológica” En consecuencia, procede la estimatoria del recurso en cuanto al Sinac a los efectos de que, con independencia de la remisión del asunto a la vía penal, analice íntegramente la situación denunciada en la vía administrativa a la luz del ordenamiento jurídico, resuelva la totalidad de los extremos alegados y, de resultar procedente, emita los actos administrativos que correspondan.

Por otra parte, la Municipalidad de Garabito también recibió la denuncia de la parte accionante en la que solicitó la intervención del gobierno local dentro del ámbito de sus competencias, verbigracia, entre otros aspectos, en lo relativo a los permisos municipales y la afectación de las obras en el aludido humedal; sin embargo, no consta que, luego de más de dos meses, se hubiese atendido la situación denunciada ni que se hubiera notificado alguna respuesta. Máxime que, según lo autos, en la inspección efectuada por las autoridades municipales se constató la inexistencia de permisos municipales. De ahí que, al estar de por medio la posible afectación al ambiente, corresponde la estimatoria del recurso también contra el municipio accionado.

VII.Voto salvado del Magistrado Salazar Alvarado. Con el debido respeto, disiento del voto de mayoría que declara con lugar el recurso, con base en las siguientes razones:

La protección a un ambiente sano y ecológicamente equilibrado, en el Ordenamiento Jurídico Costarricense, está tutelado no solo en el artículo 50, de la Constitución Política, sino también en una serie de leyes y decretos ejecutivos (reglamentos) vigentes, tales como la Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; la Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; y el Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), para citar solo algunos. Esto hace necesario, en materia ambiental, separar el control de constitucionalidad del control de legalidad. En este sentido, es criterio del suscrito que esta Sala, por vía de amparo, solo debe conocer un asunto en que se alega violación al derecho a un ambiente sano y ecológicamente equilibrado, si la Administración no ha intervenido aún y cuando la violación a ese derecho sea manifiesta y evidente, de fácil constatación, de cierta importancia o gravedad y que afecte, de forma directa, a alguna persona o comunidad en concreto.

De lo contrario, el tema debe plantearse y discutirse en la vía de legalidad. Por ello, el simple incumplimiento de obligaciones y deberes impuestos legalmente a las diversas administraciones públicas en materia ambiental es propio de ser conocido en la vía de legalidad –administrativa o jurisdiccional-, donde, con mucha mayor amplitud, podrán fiscalizarse los incumplimientos u omisiones que se acusen. Debe tenerse presente que el recurso de amparo es un proceso sumario, informal, sencillo y rápido, de manera tal, que desde el momento mismo en que la Administración interviene en un asunto ambiental, en ejercicio de sus competencias, y sustancia un procedimiento, con el dictado de actos administrativos, su conocimiento resulta ajeno al ámbito de acción de esta jurisdicción especializada. Por ello, la revisión de las actuaciones administrativas llevadas a cabo en torno a un tema ambiental que requiera, para su correcta valoración, de un proceso de conocimiento pleno, solo es posible en la jurisdicción ordinaria, toda vez que el diseño del proceso de amparo es incompatible con la contrastación o revisión de criterios técnicos o jurídicos elaborados al amparo de las normas legales o reglamentarias vigentes o con la evacuación de nuevos y mayores elementos de convicción necesarios para la contrastación o revisión de los criterios que ya consten en el expediente administrativo del caso.

Lo contrario implicaría transformar el amparo en un proceso ordinario de pleno conocimiento, con lo cual se desnaturalizaría y se tornarían nugatorios los fines para los cuales ha sido diseñado, con lo cual, perdería su condición de instrumento para la tutela eficaz de los derechos fundamentales. Como consecuencia de lo anterior, estimo que cuando un ente u órgano público ha intervenido, en diversas formas, o ha dictado actos administrativos en relación con un asunto ambiental, su conocimiento y fiscalización corresponde a la jurisdicción de lo contencioso-administrativo. Es, precisamente, la verificación de la existencia de esa intervención administrativa lo que determina que el asunto sea competencia de la vía legalidad. En consecuencia, este recurso debió haberse rechazado de plano, ya que su objeto es una cuestión propia de ser discutida, analizada y resuelta en la vía de legalidad. Empero, como no se hizo así, lo procedente es declararlo sin lugar, sin hacer pronunciamiento alguno con respecto al fondo de la cuestión planteada por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.

VIII.Documentación aportada al expediente. Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documento, ya sea en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena: 1) A David Chavarría Morales y Jeffrey Hernández Espinoza, por su orden director ejecutivo a.i. y director regional del Área de Conservación Pacífico Central, ambos del Sistema Nacional de Áreas de Conservación, o quienes ocupen esos cargos, que coordinen lo necesario, giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se analice íntegramente la situación denunciada por el accionante en la gestión de 25 de octubre de 2023, se resuelvan la totalidad de extremos alegados y, de resultar procedente, se emitan los actos administrativos que correspondan al ámbito de competencia del Sistema Nacional de Área de Conservación, todo lo cual deberá ser notificado al recurrente al medio señalado para tales efectos dentro del mismo plazo otorgado ut supra. 2) A Tobías Murillo Rodríguez, alcalde de Garabito, o a quien ocupe ese puesto, así como a quienes ejerzan el cargo de presidente del Concejo Municipal y encargado de Gestión Ambiental, ambos de la Municipalidad de Garabito, que coordinen lo necesario, giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias para que, en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se analice íntegramente la situación denunciada por el accionante en la gestión de octubre de 2023, se resuelvan la totalidad de extremos alegados y, de resultar procedente, se emitan los actos administrativos que correspondan al ámbito de competencia de ese gobierno local, todo lo cual deberá ser notificado al recurrente al medio señalado para tales efectos dentro del mismo plazo otorgado ut supra.

Se advierte a las autoridades recurridas que, de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de Garabito al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Salazar Alvarado salva el voto y declara sin lugar el recurso, por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.
