Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twenty a.m. on February twenty-third, two thousand twenty-four.
Amparo proceeding (recurso de amparo) processed under expediente nro. 23-027430- 0007-CO, filed by [Nombre01 001], identity card [Valor CED01], against the SECRETARÍA TÉCNICA NACIONAL AMBIENTAL (SETENA) and the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC).
Findings:
Nombre03 AEL-0019-2023, through official letter SETENA-SG-0177-2023 dated February 28, 2023, was informed therein that, with respect to wetlands (humedales), the verification performed by Nombre02 consists of comparing the information submitted by the proponent against the official wetland layers published by the Sistema Nacional de Áreas de Conservación (SINAC). That analysis concluded that the classification made by the proponent in the case file (expediente) fully matched the official SINAC wetland layer throughout the study area and was therefore accepted. Furthermore, Directriz N° 09-2023-MINAE states in POR TANTO FIFTH and TENTH: “FIFTH: The technical input document entitled ‘Characterization and Delimitation of Wetlands in the Maritime-Terrestrial Zone of the Coastline of the Canton of Talamanca’ dated June 13, 2021, has not been approved by the Dirección Regional del Área de Conservación La Amistad Caribe for use as a document of general applicability.
It is an internal technical input whose process of validation and official adoption by the Consejo Nacional de Áreas de Conservación del Sistema Nacional del Áreas de Conservación has not been completed, pursuant to Article 6 of Decreto Ejecutivo No.42.760-MINAE, Technical Criteria for the Location, Identification, Classification, and Delimitation of Wetland Ecosystems. Consequently, it is not an official document and may not be used for the issuance of official administrative acts (actos administrativos).” TENTH: Internal documents that have not received the corresponding official adoption may not be used as though they had, and any official who improperly uses them and creates unfounded expectations of legal entitlement shall be held responsible. Furthermore, it should be emphasized that this Secretariat could not evaluate studies or information submitted by a third party; therefore, it reviewed only what was submitted by the proponent, in this case the Municipalidad de Talamanca.
Based on the foregoing explanation, it is concluded that the appellant’s assertion is unfounded and that the appellant likewise cannot seek, through constitutional proceedings, to alter a duly reasoned technical and administrative analysis issued by SETENA. This Secretariat acted in accordance with its powers. It should also be stated that wetlands fall within the jurisdiction of the Sistema Nacional de Áreas de Conservación and that, consequently, as the supervisory entity for this matter, it has the authority to take any measures it deems appropriate upon discovering a situation that endangers this natural capital. It should further be stated that, had this Secretariat received any communication indicating that there are indeed wetland areas that must be excluded from the regulatory plan (Plan Regulador) approved by SETENA, it would have acted immediately and accordingly with respect to the affected area.
To date, no such situation has arisen because, pursuant to an order issued by this same Chamber (Sala), SINAC must delimit the wetlands in the area; once the institution complies with that order, Nombre02 will take the corresponding action within the scope of its powers regarding what is approved under the regulatory plan and what must be excluded from it. Third: Conclusions In light of all the foregoing, it is concluded that Nombre02 acted as technically and legally required in addressing the request submitted by the appellant, irrespective of whether that was the outcome expected by the appellant. Accordingly, the proper course is to dismiss the writ of amparo (recurso de amparo) filed against this Secretariat.” It requests that the action be dismissed.

Considerations:
I.Subject matter of the appeal (Objeto del recurso). The petitioner states that the respondent authority granted Environmental Viability (License) (Viabilidad [Licencia] Ambiental) for the Incorporation of the Environmental Variable into the Coastal Regulatory Plan (IVA-PRC) for the Maritime-Terrestrial Zone (ZMT) of the distrito de Cahuita, Talamanca. The foregoing occurred without compliance with the technical and legal requirements and prerequisites mandated by the legal system for such authorization. The petitioner believes that the environmental license granted with respect to the wetlands located along the coastline of the Cantón de Talamanca must be annulled.
II.Proven facts (Hechos probados). The following facts are deemed duly established and relevant to the determination of this matter:
a. Through official letter SINAC-ACLAC-DR-PNE-C-011-2017 of 30 de junio de 2017, the delimitation of the State Natural Heritage within the Maritime-Terrestrial Zone of the Cantón del Talamanca was certified in accordance with the technical and legal guidelines established in Decreto Ejecutivo N°36786-MINAET and Directriz SINAC-IRT-001-2016. (See reports submitted and evidence provided.)
b. The verification performed by Nombre02 consists of comparing the material submitted by the proponent against the official wetland layers published by the Sistema Nacional de Áreas de Conservación (SINAC). (See reports submitted and evidence provided.)
c. The verification of the studies performed by the Secretaría Técnica Nacional Ambiental concluded that the proponent in case file EAE-0002-2020, entitled “Incorporation of the Environmental Variable into the Coastal Regulatory Plan of the Distrito de Cahuita, Talamanca” (“Incorporación de la Variable Ambiental en el Plan Regulador Costero del Distrito de Cahuita, Talamanca”), classified the entire study area consistently with the official wetland layer (see report submitted under oath); d. Through resolution nro. 025-2023-Nombre02 at 10:40 on 11 de enero de 2023, the Secretaría Técnica Nacional Ambiental granted environmental viability (license) for incorporating the environmental variable into the Coastal Regulatory Plan (IVA-PRC) for the Maritime-Terrestrial Zone of the distrito de Cahuita, Talamanca (see report submitted under oath); e. Through resolution 0683-2023-Nombre02 at 09:35 on 10 de mayo de 2023, the Secretaría Técnica Nacional Ambiental addressed the delimitation of the State Natural Heritage within the Maritime-Terrestrial Zone, and the area of the Reserva Indígena de Këköldi was excluded from the environmental viability (license) (see report submitted under oath); f. Through resolution 1686-2023-Nombre02 at 09:30 on 03 de noviembre del 2023, the Secretaría Técnica Nacional Ambiental ruled on the petition to annul the Viability granted to the Plan Regulador de Cahuita, filed by the petitioner, as follows: “…this Secretariat did in fact proceed to analyze the relief requested by the moving party and determined that, as a matter of legality and legal certainty, the claim cannot be granted, because, after analyzing each of the arguments presented in order to clarify the issue, it was determined that the resolution shows no defects in the elements comprising the act itself (per se), since the grounds supporting it are technically consistent; accordingly, neither the basis nor the procedure of the administrative act was adversely affected, and the act satisfies the statutory prerequisites established in the Ley General de la Administración Pública.
Because the Administration cannot annul an act such as the challenged resolution, which constitutes a declaration of a license granted to the regulated party, given that declaring an administrative act null and void is exceptional in nature, and because what is alleged in this case does not concern the Viability act itself but rather technical matters relating to the IFA Assessment (Evaluación del IFA), which in any event has been shown to comply with the methodology and regulations, it is reiterated that, because the facts mentioned do not affect any element of the administrative act through which the Environmental Viability License was granted, they cannot cause the resolution under review to be annulled, in observance of the principles of legality, preservation of the administrative act, the binding nature of one’s own acts, and legal certainty” (see report submitted under oath); g. Directriz N° 09-2023-MINAE states in its FOURTH and SEVENTH operative provisions (POR TANTO CUARTO y SÉTIMO): “FOURTH: Document SINAC-ACLAC-DR-PNE-C-011-2017, dated 30 de junio, 2017, signed by Regional Director Ing. Edwin Cyrus Cyrus, Certifies the Delimitation of the State Natural Heritage within the Maritime-Terrestrial Zone of the Cantón de Talamanca.
This Certification was issued in accordance with the technical and legal guidelines, is the official document, and is the only one currently in force.” “SEVENTH: The official boundaries of the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo are those established in Ley No.9223, Reconocimiento de los derechos de los habitantes del Caribe Sur, in force since 8 de abril, 2014. No subsequent modification has been issued by the Ministerio de Ambiente y Energía.” h. Directive No. 09-2023-MINAE states in its FIFTH and TENTH OPERATIVE PROVISIONS: “FIFTH: The technical input document entitled ‘Characterization and Delimitation of Wetlands (humedales) in the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) along the Coastline of the Canton of Talamanca,’ dated June 13, 2021, has not been approved by the Regional Directorate of Área de Conservación La Amistad Caribe for use as a document of general application.
It is an internal technical input whose validation and official adoption process by the Consejo Nacional de Áreas de Conservación del Sistema Nacional del Áreas de Conservación has not been completed, pursuant to Article 6 of Decreto Ejecutivo No.42.760-MINAE, Technical Criteria for the Location, Identification, Classification, and Delimitation of Wetland Ecosystems. Consequently, it is not an official document and may not be used to issue official administrative acts.” “TENTH: Internal documents that have not received the corresponding official adoption may not be used as though they had, and any official who improperly uses them and creates unfounded expectations of legal rights shall be held responsible.” i. According to Nombre02, once the Sistema Nacional de Áreas de Conservación determines the boundaries of the State Natural Heritage (Patrimonio Natural del Estado) that must be added to the total area of Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, those areas must be excluded from the proposed Maritime-Terrestrial Zone Regulatory Plan (Plan Regulador de Zona Marítimo Terrestre) for the district of Cahuita in the canton of Talamanca (see report submitted under oath).
j. The Regional Director of Área de Conservación La Amistad Caribe clarified that the document entitled “Characterization and Delimitation of Wetlands in the Maritime-Terrestrial Zone along the Coastline of the Canton of Talamanca” has not been approved by the Regional Directorate of Área de Conservación La Amistad Caribe for use as a document of general application (see report submitted under oath); k. The document entitled “Characterization and Delimitation of Wetlands in the Maritime-Terrestrial Zone along the Coastline of the Canton of Talamanca” is an internal technical guide of the Sistema Nacional de Áreas de Conservación, the information in which has neither been validated nor officially adopted by the Consejo Nacional de Áreas de Conservación del Sistema Nacional de Áreas de Conservación (see report submitted under oath).
BACKGROUND RELEVANT TO THE SPECIFIC CASE. - In judgment No. 2024003959, issued at 09:30 on February 16, 2024, this Chamber ruled on the document entitled “Characterization and Delimitation of Wetlands in the Maritime-Terrestrial Zone along the Coastline of the Canton of Talamanca,” dated June 13, 2021, holding, insofar as relevant:
“VII.- In this particular case, the Acting Regional Director of Área de Conservación La Amistad Caribe informed this Court in her report that the document entitled ‘Characterization and Delimitation of Wetlands in the Maritime-Terrestrial Zone along the Coastline of the Canton of Talamanca’ has not been approved by the Regional Directorate of Área de Conservación La Amistad Caribe for use as a document of general application and that it is an internal technical guide of the Sistema Nacional de Áreas de Conservación that has yet to be validated or officially adopted by the Consejo Nacional de Áreas de Conservación del Sistema Nacional de Áreas de Conservación. She further stated that official letter No. SINAC-ACLAC-DR-PNE-C-011-2017 of June 30, 2017 certified the delimitation of the State Natural Heritage within the Maritime-Terrestrial Zone of the canton of Talamanca—taking wetlands into account for purposes of their protection.
Moreover, despite requests that the report be supplemented, the only explanation provided focuses on those two specific formal matters: what was certified as State Natural Heritage in 2017 and the preliminary status of the 2021 study. It fails, however, to address technical or material obstacles to updating that aspect of the State Natural Heritage. In other words, it does not inform the Chamber of the current condition of the wetlands in the canton of Talamanca, nor does it offer any reason why the studies supporting the 2017 decision are technically superior to the 2021 material. Conversely, it does not set forth the reasons why the 2021 study does not reflect reality or satisfy technical criteria for protecting the State Natural Heritage. Accordingly, this Court finds that, under the precautionary principle (principio precautorio), because this amparo proceeding concerns environmentally significant assets forming part of the State Natural Heritage—specifically, the wetlands within the Maritime-Terrestrial Zone along the coastline of the canton of Talamanca—the petition must be granted, with the consequences set forth in the operative portion of this judgment.” Accordingly, given that judgment No. 2024003959, issued at 09:30 on February 16, 2024, ruled on those matters, and in the absence of new elements that would warrant changing the position stated therein, the petitioner shall abide by the decision in the cited judgment.
In the case at hand (sub lite), the petitioner states that the respondent authority granted Environmental Viability (License) (Viabilidad [Licencia] Ambiental) for the Incorporation of the Environmental Variable into the Coastal Regulatory Plan (IVA-PRC) for the Maritime-Terrestrial Zone (ZMT) of the district of Cahuita, Talamanca. This authorization was granted without compliance with the technical and legal requirements and prerequisites imposed by the legal system. The petitioner contends that the environmental license granted in relation to the wetlands located along the coastline of the Canton of Talamanca must be annulled.
From the report submitted by the representatives of the respondent authorities—which is deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and from the body of evidence, it is deemed established that, by official letter SINAC-ACLAC-DR-PNE-C-011-2017 dated June 30, 2017, the delimitation of the Patrimonio Natural del Estado in the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) of the Canton of Talamanca was certified in accordance with the technical and legal guidelines established in Decreto Ejecutivo N°36786-MINAET and Directive SINAC-IRT-001-2016. In that regard, the respondent authority explains that the verification performed by Nombre02 for the granting of the environmental feasibility (license) (viabilidad [licencia] ambiental) at issue consists of comparing the materials submitted by the proponent with the official wetland layers published by the Sistema Nacional de Áreas de Conservación (SINAC).
In view of the foregoing, the review of the studies conducted by the Secretaría Técnica Nacional Ambiental concluded that the proponent in expediente EAE-0002-2020, entitled “Incorporación de la Variable Ambiental en el Plan Regulador Costero del Distrito de Cahuita, Talamanca,” had classified the entire study area consistently with the official wetland layer. Consequently, by Resolution No. 025-2023-Nombre02 at 10:40 a.m. on January 11, 2023, the Secretaría Técnica Nacional Ambiental granted environmental feasibility for the incorporation of the environmental variable into the Coastal Regulatory Plan (Plan Regulador Costero) (IVA-PRC) for the Maritime-Terrestrial Zone of the district of Cahuita, Talamanca. It is likewise established that, subsequently, by Resolution 0683-2023-Nombre02 at 09:35 a.m. on May 10, 2023, the Secretaría Técnica Nacional Ambiental excluded the area of the Reserva Indígena de Këköldi from the environmental feasibility, in accordance with the delimitation of the Patrimonio Natural del Estado in the Maritime-Terrestrial Zone.
Furthermore, it is deemed established that, by Resolution 1686-2023-Nombre02 at 09:30 a.m. on November 03, 2023, the Secretaría Técnica Nacional Ambiental ruled as follows on the application for annulment (gestión de nulidad) of the Feasibility granted to the Plan Regulador de Cahuita, filed by the appellant: “…this Secretariat did in fact analyze the relief sought by the incidental applicant and determined that, as a matter of legality and legal certainty, his claim could not be granted. After each of the arguments presented was analyzed in order to clarify the matter, it was determined that the resolution did not disclose defects in the elements comprising the act per se, because the grounds supporting it were shown to be technically consistent. Accordingly, neither the basis nor the procedure of the administrative act (acto administrativo) was impaired, and the act satisfies the statutory requirements established in the Ley General de la Administración Pública.
Given that the Administration cannot annul an act such as the challenged resolution, which declares that a license has been granted to the regulated party, since a declaration of nullity of an administrative act is exceptional in nature, and because the allegations in the present case do not concern the Feasibility act itself but rather technical aspects relating to the IFA Assessment, which in any event have been shown to comply with the methodology and regulations, it is reiterated that, because the facts cited do not impair any element of the administrative act through which the Environmental License Feasibility was granted, they cannot result in the annulment of the resolution under review, in observance of the principles of legality, preservation of the administrative act, the binding nature of one’s own acts, and legal certainty.” It has likewise been deemed established that Directive N° 09-2023-MINAE states in its FOURTH and SEVENTH POR TANTO provisions: “FOURTH: Document SINAC-ACLAC-DR-PNE-C-011-2017, dated June 30, 2017, signed by Regional Director Eng.
Edwin Cyrus Cyrus, Certifies the Delimitation of the Patrimonio Natural del Estado in the Maritime-Terrestrial Zone of the Canton of Talamanca. This Certification was issued in accordance with the technical and legal guidelines and is the official document, as well as the only document currently in force.” “SEVENTH: The official boundaries of the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo are those established in Law No.9223, Recognition of the Rights of the Inhabitants of the Southern Caribbean, in force since April 8, 2014. No subsequent amendment has been issued by the Ministerio de Ambiente y Energía.” Its FIFTH and TENTH POR TANTO provisions state: “FIFTH: The technical input document entitled ‘Characterization and Delimitation of Wetlands in the Maritime-Terrestrial Zone along the Coastline of the Canton of Talamanca,’ dated June 13, 2021, has not been approved by the Dirección Regional del Área de Conservación La Amistad Caribe for use as a document of general application.
It is an internal technical input whose validation and formal adoption process by the Consejo Nacional de Áreas de Conservación del Sistema Nacional del Áreas de Conservación has not been completed, as required by Article 6 of Decreto Ejecutivo No.42.760-MINAE, Technical Criteria for the Location, Identification, Classification, and Delimitation of Wetland Ecosystems. Consequently, it is not an official document and may not be used to issue official administrative acts.” “TENTH: Internal documents that have not received the corresponding formal approval may not be used as official documents, and any official who improperly uses them and thereby creates unfounded expectations of legal rights shall be held responsible.” In this regard, the regional director of the Área de Conservación La Amistad Caribe clarified that the document entitled “Characterization and Delimitation of Wetlands in the Maritime-Terrestrial Zone along the Coastline of the Canton of Talamanca” has not been approved by the Dirección Regional del Área de Conservación La Amistad Caribe for use as a document of general application, and that it is an internal technical guide of the Sistema Nacional de Áreas de Conservación whose information has not been validated or formally adopted by the Consejo Nacional de Áreas de Conservación del Sistema Nacional de Áreas de Conservación.
Finally, it is established that, according to SETENA, once the Sistema Nacional de Áreas de Conservación determines the boundaries of the Patrimonio Natural del Estado that must be added to the total area of the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, those areas must be excluded from the proposed Plan Regulador de Zona Marítimo Terrestre for the district of Cahuita in the canton of Talamanca.
Accordingly, the appellant disagrees with the environmental feasibility granted by the respondent authority through Resolution No. 025-2023-Nombre02 at 10:40 a.m. on January 11, 2023, which was in turn upheld by Resolution 1686-2023-Nombre02 at 09:30 a.m. on November 03, 2023. In this regard, according to the information provided under oath, the verification performed by Nombre02 for the granting of the environmental feasibility at issue consists of comparing the materials submitted by the proponent with the official wetland layers published by the Sistema Nacional de Áreas de Conservación (SINAC), a verification that was in fact performed at the appropriate time. It is also established that Directive N° 09-2023-MINAE sets forth the Delimitation of the Patrimonio Natural del Estado in the Maritime-Terrestrial Zone of the Canton of Talamanca, and that the license challenged in this proceeding was issued in accordance with the regulations in force.
In addition, according to SETENA, if the boundaries of the Patrimonio Natural del Estado are modified, specifically within the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, the affected areas must be excluded from the proposed Plan Regulador de Zona Marítimo Terrestre for the district of Cahuita in the canton of Talamanca. In other words, the environmental feasibility may be modified if new information warrants its review; according to the information provided under oath, this has not occurred in the present matter.
Having established the foregoing, given that this Chamber, by Judgment N° 2024003959 at 09:30 a.m. on February 16, 2024, ruled, insofar as relevant: “POR TANTO: The application for relief (recurso de amparo) is granted. It is ordered: i) that Maylin Mora Arias, in her capacity as acting regional director of the Área de Conservación La Amistad Caribe del Sistema Nacional del Áreas de Conservación, or whoever may serve in that position in her stead, complete, within THREE MONTHS from notice of this judgment, the procedure to supplement the certification of the Patrimonio Natural del Estado in the Maritime-Terrestrial Zone of the Canton of Talamanca with the June 2021 ‘Characterization and Delimitation of Wetlands in the Maritime-Terrestrial Zone along the Coastline of the Canton of Talamanca’; (…)”, the respondent Secretariat is advised that, once that judgment has been complied with, it must, within the scope of its authority, review the environmental feasibility challenged in this proceeding and determine the appropriate course of action. The application for relief against it is not deemed meritorious because this concerns a subsequent event; however, as stated, it must take note of the decision.
Protection of the right to a healthy and ecologically balanced environment (ambiente sano y ecológicamente equilibrado) under the Costa Rican Legal System is safeguarded not only by Article 50 of the Political Constitution, but also by a series of laws and executive decrees (regulations) currently in force, such as the Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; the Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; the Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; and Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), to name only a few. This makes it necessary, in environmental matters, to distinguish constitutional review (control de constitucionalidad) from legality review (control de legalidad). In this regard, it is the undersigned’s view that this Chamber, through an amparo proceeding (recurso de amparo), should hear a matter alleging a violation of the right to a healthy and ecologically balanced environment only if the Administration has not yet intervened and if the violation of that right is manifest and evident, readily ascertainable, of some importance or seriousness, and directly affects a specific person or community.
Otherwise, the matter must be raised and litigated through legality proceedings (vía de legalidad). Accordingly, mere noncompliance with obligations and duties legally imposed upon the various public administrations in environmental matters is properly addressed through legality proceedings—whether administrative or judicial—where the alleged instances of noncompliance or omissions may be reviewed much more comprehensively. It must be borne in mind that an amparo proceeding is summary, informal, simple, and expeditious; therefore, from the very moment the Administration intervenes in an environmental matter in the exercise of its powers and conducts a proceeding involving the issuance of administrative acts (actos administrativos), review of that matter falls outside the scope of this specialized jurisdiction. Thus, review of administrative actions taken in connection with an environmental matter that, for proper assessment, requires full evidentiary proceedings (proceso de conocimiento pleno) is possible only before the ordinary courts, since the design of the amparo proceeding is incompatible with examining or reviewing technical or legal criteria developed under the applicable statutory or regulatory provisions, or with the taking of additional and more extensive evidence necessary to examine or review the criteria already contained in the administrative record (expediente administrativo) for the case.
To hold otherwise would transform the amparo proceeding into an ordinary proceeding involving full adjudication, thereby distorting its nature and frustrating the purposes for which it was designed; it would thus lose its status as an instrument for the effective protection of fundamental rights. Consequently, I consider that when a public entity or body has intervened in various ways or has issued administrative acts in connection with an environmental matter, its review and oversight fall within the jurisdiction of the administrative courts (jurisdicción de lo contencioso-administrativo). It is precisely verification of the existence of such administrative intervention that determines that the matter falls within the jurisdiction of legality proceedings. Consequently, this proceeding should have been summarily dismissed with respect to this issue, because its subject matter is properly to be argued, analyzed, and resolved through legality proceedings.
However, since that was not done, the appropriate course is to deny the proceeding without making any determination whatsoever on the merits of the matter raised, because it is for the ordinary courts—specifically, the administrative courts—to determine whether the challenged administrative actions and conduct substantively comply with the provisions of the statutory legal framework regarding the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment.
The petitioner is hereby advised that, if any paper document was submitted, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, such items must be collected from the court office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 del 22 de agosto del 2011, artículo XXVI and published in Boletín Judicial número 19 del 26 de enero del 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
With respect to the Sistema Nacional de Áreas de Conservación, the petitioner shall abide by the ruling in judgment N° 2024003959 de las 09:30 horas del 16 de febrero de 2024. With respect to the Secretaria Técnica Ambiental, the proceeding is denied. The Secretaria Técnica Ambiental shall take note of the matters stated in considerando IV of this decision. Justice Salazar Alvarado provides differing reasons concerning the alleged violation of the right to a healthy and ecologically balanced environment. Let notice be served.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veintitres de febrero de dos mil veinticuatro .
Recurso de amparo que se tramita en expediente nro. 23-027430- 0007-CO, interpuesto por [Nombre01 001], cédula de identidad [Valor CED01], contra la SECRETARÍA TÉCNICA NACIONAL AMBIENTAL (SETENA) y el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC).
Resultando:
Redacta la Magistrada Hess Herrera; y,
Considerando:
I.Objeto del recurso. Manifiesta el recurrente que la autoridad recurrida otorgó la Viabilidad (Licencia) Ambiental a la Incorporación de la Variable Ambiental al Plan Regulador Costero (IVA-PRC) de la Zona Marítimo Terrestre (ZMT) del distrito de Cahuita, Talamanca. Lo anterior sin que para dicha autorización se hubieran cumplido los requisitos y presupuestos técnicos y legales exigidos por el ordenamiento jurídico. Estima el recurrente que debe anularse la licencia ambiental otorgada sobre los humedales ubicados en el litoral del Cantón de Talamanca.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
a. Que mediante el oficio SINAC-ACLAC-DR-PNE-C-011-2017 del 30 de junio de 2017 se certificó la delimitación del Patrimonio Natural del Estado en la Zona Marítimo Terrestre del Cantón del Talamanca conforme a los lineamientos técnicos y legales establecidos en el Decreto Ejecutivo N°36786-MINAET como en la Directriz SINAC-IRT-001-2016. (ver informes rendidos y prueba aportada).
b. Que la verificación que realiza la Nombre02 es contraponer lo entregado por el proponente con las capas oficiales de humedales publicadas por el Sistema Nacional de Áreas de Conservación (SINAC). (ver informes rendidos y prueba aportada).
c. La verificación de los estudios realizada por la Secretaría Técnica Nacional Ambiental concluyó que el proponente del expediente EAE-0002-2020 denominado “Incorporación de la Variable Ambiental en el Plan Regulador Costero del Distrito de Cahuita, Talamanca” hizo una clasificación coincidente en su totalidad de la zona de estudio con la capa oficial de los humedales (ver informe rendido bajo juramento); d. Mediante resolución nro. 025-2023-Nombre02 de las 10:40 horas del 11 de enero de 2023, la Secretaría Técnica Nacional Ambiental otorgó la viabilidad (licencia) ambiental a la incorporación de la variable ambiental al Plan Regulador Costero (IVA-PRC) de la Zona Marítimo Terrestre del distrito de Cahuita, Talamanca (ver informe rendido bajo juramento); e. Mediante resolución 0683-2023-Nombre02 de las 09:35 horas del 10 de mayo de 2023, la Secretaría Técnica Nacional Ambiental atendió la delimitación del Patrimonio Natural del Estado en la Zona Marítimo Terrestre y se excluye de la viabilidad (licencia) ambiental el área de la Reserva Indígena de Këköldi (ver informe rendido bajo juramento); f. Mediante resolución 1686-2023-Nombre02 de las 09:30 del 03 de noviembre del 2023, la Secretaría Técnica Nacional Ambiental resolvió el la gestión de nulidad de la Viabilidad otorgada al Plan Regulador de Cahuita, interpuesta por el recurrente, de la siguiente manera: “…esta Secretaría efectivamente procedió a analizar lo solicitado por el incidentista y se determina que por un asunto de legalidad y seguridad jurídica no es procedente aceptar su pretensión, ya que analizadas cada una de las argumentaciones expuestas, a efectos que quedara en claro el tema, se determinó que en la resolución no se evidencian vicios en los elementos que conforman el acto perse, al demostrarse que la motivación de la misma, desde el punto de vista técnico, es congruente, con lo cual no se afectó ni el motivo, ni el procedimiento del acto administrativo, el cual cumple los presupuestos de la norma establecidos en la Ley General de la Administración Pública.
Dado que la Administración no puede anular un acto como la resolución que se recurre, que es declaratoria de una licencia otorgada al administrado toda vez que la declaratoria de nulidad de un acto administrativo es de carácter excepcional y en el presente caso lo que se está alegando no se relaciona con el acto mismo de Viabilidad, sino con aspectos de corte técnico de cara a la Evaluación del IFA, que en todo caso se ha demostrado que cumplen con la metodología y reglamentación, se reitera que los hechos mencionados al no afectar alguno de los elementos del acto administrativo por el cual se otorgó la Viabilidad Licencia Ambiental no pueden generar que la resolución en análisis sea anulada, en acatamiento de los principios de legalidad, de conservación del acto administrativo, intangibilidad de los actos propios y por seguridad jurídica” (ver informe rendido bajo juramento); g. Que la Directriz N° 09-2023-MINAE, en los POR TANTO CUARTO y SÉTIMO, se señala: “CUARTO: El documento SINAC-ACLAC-DR-PNE-C-011-2017, del 30 de junio, 2017, suscrito por el Director Regional Ing. Edwin Cyrus Cyrus, Certifica la Delimitación del Patrimonio Natural del Estado en la Zona Marítimo Terrestre del Cantón de Talamanca.
Esta Certificación, fue emitida conforme a los lineamientos técnicos y legales y es el documento con carácter oficial, siendo el único vigente, a la fecha.” “SÉTIMO: Los límites oficiales del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo son los establecidos en la Ley No.9223, Reconocimiento de los derechos de los habitantes del Caribe Sur, vigente desde el 8 de abril, 2014. No existe ninguna modificación posterior que haya sido emitida por el Ministerio de Ambiente y Energía.” h. Que la Directriz N° 09-2023-MINAE, en los POR TANTO QUINTO y DÉCIMO, se señala: “QUINTO: El documento insumo técnico denominado “Caracterización y Delimitación de Humedales en la Zona Marítimo Terrestre del Litoral del Cantón de Talamanca” del 13 de junio, 2021, no ha sido aprobado por la Dirección Regional del Área de Conservación La Amistad Caribe para utilizarse como un documento de alcance general. Este es un insumo técnico, de carácter interno que no ha finalizado con el proceso para su validación y oficialización por el Consejo Nacional de Áreas de Conservación del Sistema Nacional del Áreas de Conservación, conforme al artículo 6 del Decreto Ejecutivo No.42.760-MINAE, Criterios Técnicos para la ubicación, identificación, clasificación y delimitación de ecosistemas de humedal.
Por consiguiente, no es un documento oficial, ni podrá ser utilizado para emisión de actos administrativos oficiales.” “DÉCIMO: Los documentos de carácter interno que no cuenten con la oficialización que le corresponde, no pueden ser utilizados como tales, siendo responsable el funcionario que haga un uso indebido y genere expectativas de derecho, que son improcedentes.” i. Que según informa Nombre02, una vez que el Sistema Nacional de Áreas de Conservación determine los límites del Patrimonio Natural del Estado que deben sumarse al área total del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, éstos deben ser excluidos de la propuesta del Plan Regulador de Zona Marítimo Terrestre del distrito de Cahuita del cantón de Talamanca (ver informe rendido bajo juramento).
j. La directora regional del Área de Conservación La Amistad Caribe aclaró que el documento denominado “Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca” no ha sido aprobado por la Dirección Regional del Área de Conservación La Amistad Caribe para utilizarse como un documento de alcance general (ver informe rendido bajo juramento); k. El documento denominado “Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca” es una guía técnica interna del Sistema Nacional de Áreas de Conservación, cuya información no ha sido validada ni oficializada por parte del Consejo Nacional de Áreas de Conservación del Sistema Nacional de Áreas de Conservación (ver informe rendido bajo juramento).
ANTECEDENTE DE INTERÉS PARA AL CASO CONCRETO. - Esta Sala mediante sentencia N° 2024003959 de las 09:30 horas del 16 de febrero de 2024, se pronunció respecto al documento denominado “Caracterización y Delimitación de Humedales en la Zona Marítimo Terrestre del Litoral del Cantón de Talamanca” del 13 de junio de 2021, resolviéndose en lo que interesa:
“VII.- En este caso en particular, la directora regional a. i. del Área de Conservación La Amistad Caribe indicó a este Tribunal, en su informe, que el documento denominado “Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca” no ha sido aprobado por la Dirección Regional del Área de Conservación La Amistad Caribe para utilizarse como un documento de alcance general y que se trata de una guía técnica interna del Sistema Nacional de Áreas de Conservación, aún sin validar ni oficializar por parte del Consejo Nacional de Áreas de Conservación del Sistema Nacional de Áreas de Conservación. Asimismo, que mediante oficio No. SINAC-ACLAC-DR-PNE-C-011-2017 del 30 de junio de 2017 se certificó la delimitación del Patrimonio Natural del Estado en la Zona Marítimo Terrestre del cantón de Talamanca -considerando los humedales para su protección-.
Por otra parte, pese a las solicitudes de ampliación de informe la única explicación ofrecida se concentra en esos dos aspectos formales puntuales: lo que se certificó como patrimonio natural del Estado en 2017 y la condición preliminar del estudio de 2021. Sin embargo, omite referirse a obstáculos de índole técnico o material para actualizar ese aspecto del patrimonio natural del Estado. Es decir, no indica a la Sala cuál es el estado actual de los humedales en el cantón de Talamanca, ni ofrece razón alguna por la cual los estudios que justificaron la decisión de 2017 son técnicamente superiores al material de 2021. O, dicho a la inversa, no se exponen los motivos por los cuales el estudio de 2021 no corresponden a la realidad o a criterios técnicos de tutela del patrimonio natural del Estado. Por lo anterior, considera este Tribunal que en aplicación del principio precautorio, al versar este amparo sobre bienes ambientalmente relevantes, constitutivos del patrimonio natural del Estado, específicamente de los humedales en la zona marítimo terrestre del litoral del cantón de Talamanca, debe declararse con lugar el recurso con las consecuencias expuestas en la parte dispositiva de esta sentencia.” Así las cosas, siendo que mediante sentencia N° 2024003959 de las 09:30 horas del 16 de febrero de 2024, se emitió pronunciamiento sobre tales extremos, y al no existir nuevos elementos que permitan variar el criterio vertido, deberá estarse el recurrente a lo resuelto en la sentencia de cita.
En el sub lite, manifiesta el recurrente que la autoridad recurrida otorgó la Viabilidad (Licencia) Ambiental a la Incorporación de la Variable Ambiental al Plan Regulador Costero (IVA-PRC) de la Zona Marítimo Terrestre (ZMT) del distrito de Cahuita, Talamanca. Lo anterior sin que para dicha autorización se hubieran cumplido los requisitos y presupuestos técnicos y legales exigidos por el ordenamiento jurídico. Estima el recurrente que debe anularse la licencia ambiental otorgada sobre los humedales ubicados en el litoral del Cantón de Talamanca.
Del informe rendido por los representantes de las autoridades recurridas -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y del elenco probatorio, se tiene por acreditado que mediante el oficio SINAC-ACLAC-DR-PNE-C-011-2017 del 30 de junio de 2017 se certificó la delimitación del Patrimonio Natural del Estado en la Zona Marítimo Terrestre del Cantón del Talamanca conforme a los lineamientos técnicos y legales establecidos en el Decreto Ejecutivo N°36786-MINAET como en la Directriz SINAC-IRT-001-2016. En ese sentido, explica la autoridad recurrida que la verificación que realiza la Nombre02 para el otorgamiento de la viabilidad (licencia) ambiental que se reclama, es contraponer lo entregado por el proponente con las capas oficiales de humedales publicadas por el Sistema Nacional de Áreas de Conservación (SINAC).
Atendiendo lo anterior, la verificación de los estudios realizada por la Secretaría Técnica Nacional Ambiental concluyó que el proponente del expediente EAE-0002-2020 denominado “Incorporación de la Variable Ambiental en el Plan Regulador Costero del Distrito de Cahuita, Talamanca” hizo una clasificación coincidente en su totalidad de la zona de estudio con la capa oficial de los humedales y en consecuencia, por resolución nro. 025-2023-Nombre02 de las 10:40 horas del 11 de enero de 2023, la Secretaría Técnica Nacional Ambiental otorgó la viabilidad (licencia) ambiental a la incorporación de la variable ambiental al Plan Regulador Costero (IVA-PRC) de la Zona Marítimo Terrestre del distrito de Cahuita, Talamanca. De igual forma, se tiene que, posteriormente, mediante resolución 0683-2023-Nombre02 de las 09:35 horas del 10 de mayo de 2023, la Secretaría Técnica Nacional Ambiental excluyó de la viabilidad (licencia) ambiental el área de la Reserva Indígena de Këköldi, en atención a la delimitación del Patrimonio Natural del Estado en la Zona Marítimo Terrestre.
Por otra parte, se tiene por demostrado que, mediante resolución 1686-2023-Nombre02 de las 09:30 del 03 de noviembre del 2023, la Secretaría Técnica Nacional Ambiental resolvió la gestión de nulidad de la Viabilidad otorgada al Plan Regulador de Cahuita, interpuesta por el recurrente, de la siguiente manera: “…esta Secretaría efectivamente procedió a analizar lo solicitado por el incidentista y se determina que por un asunto de legalidad y seguridad jurídica no es procedente aceptar su pretensión, ya que analizadas cada una de las argumentaciones expuestas, a efectos que quedara en claro el tema, se determinó que en la resolución no se evidencian vicios en los elementos que conforman el acto per se, al demostrarse que la motivación de la misma, desde el punto de vista técnico, es congruente, con lo cual no se afectó ni el motivo, ni el procedimiento del acto administrativo, el cual cumple los presupuestos de la norma establecidos en la Ley General de la Administración Pública.
Dado que la Administración no puede anular un acto como la resolución que se recurre, que es declaratoria de una licencia otorgada al administrado toda vez que la declaratoria de nulidad de un acto administrativo es de carácter excepcional y en el presente caso lo que se está alegando no se relaciona con el acto mismo de Viabilidad, sino con aspectos de corte técnico de cara a la Evaluación del IFA, que en todo caso se ha demostrado que cumplen con la metodología y reglamentación, se reitera que los hechos mencionados al no afectar alguno de los elementos del acto administrativo por el cual se otorgó la Viabilidad Licencia Ambiental no pueden generar que la resolución en análisis sea anulada, en acatamiento de los principios de legalidad, de conservación del acto administrativo, intangibilidad de los actos propios y por seguridad jurídica”. Igualmente, se ha tenido por demostrado que, la Directriz N° 09-2023-MINAE, en los POR TANTO CUARTO y SÉTIMO, señala: “CUARTO: El documento SINAC-ACLAC-DR-PNE-C-011-2017, del 30 de junio, 2017, suscrito por el Director Regional Ing. Edwin Cyrus Cyrus, Certifica la Delimitación del Patrimonio Natural del Estado en la Zona Marítimo Terrestre del Cantón de Talamanca.
Esta Certificación, fue emitida conforme a los lineamientos técnicos y legales y es el documento con carácter oficial, siendo el único vigente, a la fecha.” “SÉTIMO: Los límites oficiales del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo son los establecidos en la Ley No.9223, Reconocimiento de los derechos de los habitantes del Caribe Sur, vigente desde el 8 de abril, 2014. No existe ninguna modificación posterior que haya sido emitida por el Ministerio de Ambiente y Energía.” y en los POR TANTO QUINTO y DÉCIMO, se señala: “QUINTO: El documento insumo técnico denominado “Caracterización y Delimitación de Humedales en la Zona Marítimo Terrestre del Litoral del Cantón de Talamanca” del 13 de junio, 2021, no ha sido aprobado por la Dirección Regional del Área de Conservación La Amistad Caribe para utilizarse como un documento de alcance general. Este es un insumo técnico, de carácter interno que no ha finalizado con el proceso para su validación y oficialización por el Consejo Nacional de Áreas de Conservación del Sistema Nacional del Áreas de Conservación, conforme al artículo 6 del Decreto Ejecutivo No.42.760-MINAE, Criterios Técnicos para la ubicación, identificación, clasificación y delimitación de ecosistemas de humedal.
Por consiguiente, no es un documento oficial, ni podrá ser utilizado para emisión de actos administrativos oficiales.” “DÉCIMO: Los documentos de carácter interno que no cuenten con la oficialización que le corresponde, no pueden ser utilizados como tales, siendo responsable el funcionario que haga un uso indebido y genere expectativas de derecho, que son improcedentes.” En ese sentido, la directora regional del Área de Conservación La Amistad Caribe aclaró que el documento denominado “Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca” no ha sido aprobado por la Dirección Regional del Área de Conservación La Amistad Caribe para utilizarse como un documento de alcance general y que, el mismo es una guía técnica interna del Sistema Nacional de Áreas de Conservación, cuya información no ha sido validada ni oficializada por parte del Consejo Nacional de Áreas de Conservación del Sistema Nacional de Áreas de Conservación.
Finalmente, se tiene que, según informa SETENA, una vez que el Sistema Nacional de Áreas de Conservación determine los límites del Patrimonio Natural del Estado que deben sumarse al área total del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, éstos deben ser excluidos de la propuesta del Plan Regulador de Zona Marítimo Terrestre del distrito de Cahuita del cantón de Talamanca.
Así las cosas, se tiene que el recurrente se muestra inconforme con la viabilidad ambiental otorgada por la autoridad recurrida mediante la resolución nro. 025-2023-Nombre02 de las 10:40 horas del 11 de enero de 2023, la cual, a su vez fue confirmada por resolución 1686-2023-Nombre02 de las 09:30 del 03 de noviembre del 2023. En ese sentido, según se informa bajo juramento, la verificación que realiza la Nombre02 para el otorgamiento de la viabilidad (licencia) ambiental que se reclama, es contraponer lo entregado por el proponente con las capas oficiales de humedales publicadas por el Sistema Nacional de Áreas de Conservación (SINAC), verificación que efectivamente se dio en su momento. Asimismo, se tiene que en la Directriz N° 09-2023-MINAE, se establece la Delimitación del Patrimonio Natural del Estado en la Zona Marítimo Terrestre del Cantón de Talamanca y conforme a la normativa vigente, es que se expidió la licencia objeto de este recurso.
Aunado a lo anterior, según informa SETENA, de existir modificaciones en los límites del Patrimonio Natural del Estado, específicamente en el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, las áreas que se vean afectadas deberán ser excluidas de la propuesta del Plan Regulador de Zona Marítimo Terrestre del distrito de Cahuita del cantón de Talamanca. Es decir, la viabilidad (licencia) ambiental puede ser modificada de existir nuevos elementos que ameriten su revisión; lo cual, en el presente asunto no ha acaecido según se informa bajo juramento.
Establecido lo anterior, dado que esta Sala mediante sentencia N° 2024003959 de las 09:30 horas del 16 de febrero de 2024, dispuso en lo que interesa: “POR TANTO: Se declara con lugar el recurso. Se ordena: i) a Maylin Mora Arias, en su condición de directora regional a. i. del Área de Conservación La Amistad Caribe del Sistema Nacional del Áreas de Conservación, o a quien en su lugar ejerza ese cargo, concluir, en el plazo de TRES MESES, contado a partir de la notificación de esta sentencia, el trámite para complementar la certificación de Patrimonio Natural del Estado en la Zona Marítimo Terrestre del Cantón de Talamanca con la “Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca” de junio de 2021; (…)”, tome nota la Secretaria recurrida que una vez que, se haya dado cumplimiento a dicha sentencia, deberá proceder dentro del ámbito de sus competencias, con la revisión de la viabilidad (licencia) ambiental objeto de este recurso y determinar lo que corresponda. No se estima el amparo en su contra, por tratarse de un hecho posterior, pero como se indicó, deberá tomar nota de lo decidido.
La protección a un ambiente sano y ecológicamente equilibrado, en el Ordenamiento Jurídico Costarricense, está tutelado no solo en el artículo 50, de la Constitución Política, sino también en una serie de leyes y decretos ejecutivos (reglamentos) vigentes, tales como la Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; la Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; y el Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), para citar solo algunos. Esto hace necesario, en materia ambiental, separar el control de constitucionalidad del control de legalidad. En este sentido, es criterio del suscrito que esta Sala, por vía de amparo, solo debe conocer un asunto en que se alega violación al derecho a un ambiente sano y ecológicamente equilibrado, si la Administración no ha intervenido aún y cuando la violación a ese derecho sea manifiesta y evidente, de fácil constatación, de cierta importancia o gravedad y que afecte, de forma directa, a alguna persona o comunidad en concreto.
De lo contrario, el tema debe plantearse y discutirse en la vía de legalidad. Por ello, el simple incumplimiento de obligaciones y deberes impuestos legalmente a las diversas administraciones públicas en materia ambiental es propio de ser conocido en la vía de legalidad –administrativa o jurisdiccional-, donde, con mucha mayor amplitud, podrán fiscalizarse los incumplimientos u omisiones que se acusen. Debe tenerse presente que el recurso de amparo es un proceso sumario, informal, sencillo y rápido, de manera tal, que desde el momento mismo en que la Administración interviene en un asunto ambiental, en ejercicio de sus competencias, y sustancia un procedimiento, con el dictado de actos administrativos, su conocimiento resulta ajeno al ámbito de acción de esta jurisdicción especializada. Por ello, la revisión de las actuaciones administrativas llevadas a cabo en torno a un tema ambiental que requiera, para su correcta valoración, de un proceso de conocimiento pleno, solo es posible en la jurisdicción ordinaria, toda vez que el diseño del proceso de amparo es incompatible con la contrastación o revisión de criterios técnicos o jurídicos elaborados al amparo de las normas legales o reglamentarias vigentes o con la evacuación de nuevos y mayores elementos de convicción necesarios para la contrastación o revisión de los criterios que ya consten en el expediente administrativo del caso.
Lo contrario implicaría transformar el amparo en un proceso ordinario de pleno conocimiento, con lo cual se desnaturalizaría y se tornarían nugatorios los fines para los cuales ha sido diseñado, con lo cual, perdería, su condición de instrumento para la tutela eficaz de los derechos fundamentales. Como consecuencia de lo anterior, estimo que cuando un ente u órgano público ha intervenido, en diversas formas, o ha dictado actos administrativos en relación con un asunto ambiental, su conocimiento y fiscalización corresponde a la jurisdicción de lo contencioso-administrativo. Es, precisamente, la verificación de la existencia de esa intervención administrativa lo que determina que el asunto sea competencia de la vía legalidad. En consecuencia, este recurso debió haberse rechazado de plano en cuanto a este extremo se refiere, ya que su objeto es una cuestión propia de ser discutida, analizada y resuelta en la vía de legalidad.
Empero, como no se hizo así, lo procedente es declararlo sin lugar, sin hacer pronunciamiento alguno con respecto al fondo de la cuestión planteada por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.
Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
En cuanto a la Sistema Nacional de Áreas de Conservación, estese el recurrente a lo resuelto en la sentencia N° 2024003959 de las 09:30 horas del 16 de febrero de 2024. En cuanto a la Secretaria Técnica Ambiental, se declara sin lugar el recurso. Tome nota la Secretaria Técnica Ambiental de lo indicado en el considerando IV de esta resolución. El Magistrado Salazar Alvarado da razones distintas, en cuanto a la acusada violación del derecho a un ambiente sano y ecológicamente equilibrado. Notifíquese.
