Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine fifteen a.m. on the second of February, two thousand twenty-four.
Appeal for constitutional relief (recurso de amparo) processed under expediente número 23-030245-007-CO, filed by [Nombre01 001], identity card [CED01], and [Nombre01 002], identity card [CED02], against the MINISTERIO DE SALUD and the MUNICIPALIDAD DE SAN Nombre02 DE ALAJUELA.
Findings:
Justice Salazar Alvarado authored the opinion; and,
Considering:
I.Subject matter of the appeal. The appellants state that, on 28 de setiembre del 2023, they filed a complaint with the Municipalidad and the Ministerio de Salud concerning the improper discharge of wastewater (soapy water and sewage) into a drainage ditch. They add that, although those entities conducted the corresponding inspections and verified the problem, to date they have not acted within the scope of their authority and have not put an end to the sanitary contamination.
II.Preliminary clarification. Before analyzing the merits of the matter, it must be clarified that, beginning with Judgment Nº 2008-02545 issued at 08:55 a.m. on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which the issue is whether the Public Administration complied with the reasonably established time limits for resolving requests submitted by members of the public, in light of the provisions of artículo 41 of the Constitución Política. The present case falls within an exception because it concerns the alleged failure to resolve a request to correct the problem of sewage being discharged into a drainage ditch, causing foul odors that allegedly affect the appellants and their community and endanger life and health. In view of the foregoing, the Chamber proceeds to adjudicate the specific situation raised in this appeal.
III.Proven facts. For purposes of deciding this matter, the following facts are deemed duly established, either because they have been substantiated or because the respondent failed to address them as required in the initial order:

Sole fact. That, to date, the problem reported by the petitioners has been resolved and the relevant information communicated to the complainants.
V.Merits. Article 21 of the Constitución Política enshrines the inviolability of human life, from which the right to health derives and which, undoubtedly, is closely linked to the right of all persons to live in a healthy and ecologically balanced environment, as provided for in Article 50 of the Constitución Política. That right gives rise to the State’s obligation to ensure the timely and adequate protection of those rights through various entities and bodies, each within the scope of its respective authority. A review of the record, based on the established facts, demonstrates that since 28 de septiembre de 2023, the petitioning party filed, respectively, with the Municipality and the Área de Salud, both in the canton of San Nombre02, a complaint concerning the improper disposal of wastewater into a drainage ditch due to the alleged presence of sewage (aguas negras) and domestic wastewater (aguas servidas). Although four months have elapsed since then, the problem has not been resolved. In this regard, the actions taken by each of the respondent authorities will be analyzed.
VI.Regarding the Municipalidad de San Ramón. It should be noted that, pursuant to Article 169 of the Constitución Política, municipalities are responsible for administering local interests and services in each canton. This is the source of municipalities’ authority to plan and oversee urban development within their respective jurisdictions. This includes the duty to establish a comprehensive planning policy that ensures urban development consistent with the efficient operation of systems for supplying drinking water and collecting, treating, and finally disposing of wastewater. The foregoing likewise gives rise to the obligation to adopt the measures required to provide the canton with an adequate storm sewer system (sistema de alcantarillado pluvial), so as to guarantee its residents’ rights to health and to an environment free from pollution. Regarding the specific issue of municipal obligations concerning storm sewer systems, in Judgment N°2008-04210, issued at 13:59 on 14 de marzo de 2008, and reiterated in N° 2022000421, issued at 09:15 on 07 de enero de 2022, this Chamber stated:
“(…) In its consistent case law, this Court has recognized that the right to enjoy a healthy and ecologically balanced environment is a fundamental right derived from Article 50 of the Constitution, which not only enshrines every citizen’s right to enjoy a healthy and ecologically balanced environment but also requires the State to guarantee the exercise of that right through the mechanisms established for that purpose by the legislation in force. Specifically, as this Chamber stated in Judgment number 2005-009900, issued at ten o’clock on veintinueve de julio del dos mil cinco, the Municipality must construct the infrastructure necessary to ensure the proper flow of water, thereby guaranteeing the rights to health and to an environment free from pollution, without harming third parties: ‘(…) Regarding municipal obligations concerning storm sewer systems.- It should be borne in mind that Article 169 of the Constitución Política provides that the administration of local interests and services in each canton shall be the responsibility of the Municipal Government.
Local interests and services have been defined by the Chamber as indeterminate legal concepts (conceptos jurídicos indeterminados) whose precise content for application to specific cases is not established by law, making it necessary for the person responsible for applying them to rely on evaluative and experiential criteria in order to determine their content. The creation of adequate drainage facilities within a community so as not to cause damage to property or health or environmental problems for its residents is, under the terms set forth in the Constitución Política, an interest of the canton and part of the services that the Municipality is required to provide (…) For this reason, the Municipalidad de Goicoechea is required to undertake specific action to fulfill its purposes by adopting the measures necessary to provide the protected community with an efficient stormwater drainage system.
In accordance with standards of reasonableness, the Municipality must construct the infrastructure necessary to ensure the proper flow of that water, thereby guaranteeing the rights to health and to an environment free from pollution, without harming third parties.’” In the case under review, since 06 de octubre de 2023 the respondent authority has established that the water flowing through the reported sewer and emptying into a drainage ditch has a grayish coloration characteristic of the presence of wastewater, and that identifying the sources illegally discharging water into the stormwater collection system requires special intervention and investigation in conjunction with the Ministerio de Salud. Accordingly, the necessary coordination was undertaken to design a proposal for addressing this problem. Nevertheless, four months have elapsed without any action being taken to resolve the situation.
It should be noted that the last action taken in relation to this case was to schedule a meeting with officials of the Ministerio de Salud; that meeting was canceled, and the record discloses no subsequent action, whether individual or joint, aimed at resolving the problem. Thus, although the respondent Municipality has been fully aware of the problems affecting the petitioners and other residents, it has failed to provide a solution to the serious problem posed by the discharge of sewage into a drainage ditch. This claim in the proceeding must therefore be granted, with the consequences detailed in the operative portion (parte dispositiva) of this decision.
VII.Regarding the Ministry of Health. In the case at bar (sublite), the Chamber deems it proven that, once the complaint filed by the appellants in the month of September 2023 was received, on October 20 of that year it conducted a site visit and found that water was indeed flowing over the stormwater channel of Dirección01 that could have originated from improper management of wastewater disposal from homes adjacent to the area, which connect to a drainage ditch (acequia). It is noted that the respondent authority has been aware of this problem since 2022 and, despite this, merely consolidated the appellants’ complaint into the main case file; following notification of the report prepared as a result of the inspection, the Chamber has no evidence that it performed or issued any administrative act (acto administrativo) for the purpose of conducting the respective investigation, carrying out the corresponding analyses, and, if warranted, issuing health orders (órdenes sanitarias).
In other words, the case file has remained inactive for more than two months, evidencing a lack of interest in resolving the reported problem. Indeed, it has not even coordinated a meeting with officials of the Municipalidad de San Nombre02 to evaluate a joint solution. In this regard, Article 355 of the Ley General de Salud provides that the Ministry of Health is responsible for ordering and taking the special measures authorized by law to prevent risks or harm to human health, or to prevent such risks or harm from spreading or worsening, and to prevent the continuation or repetition of violations of laws or regulations that threaten human health. Accordingly, approximately four months have elapsed since the appellant filed the complaint, and to date no decision has been received in that regard, even though the Municipalidad de San Ramón warned them of the situation and the problems it is causing to the health of local residents.
It is noted that the Ministry of Health’s governing role does not end merely with an inspection of the reported site, but includes the issuance of health orders, notification of the offender, and the obligation to verify that the measures ordered are fully complied with, using for such purposes the mechanisms granted to it by the legal system. Thus, from the standpoint of Constitutional Law, it is unacceptable that, to date, the appellants’ complaint has not been resolved and the appropriate measures have not been issued to remedy the problem affecting local residents; consequently, the alleged violation of the fundamental rights of the protected party and the community has been established.
VIII.Note by Justice Castillo Víquez regarding prompt and effective administrative justice (justicia administrativa pronta y cumplida). I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), jurisdiction over the legal dispute lies with the Contentious-Administrative Courts and not with this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the constitutional protection proceeding (recurso de amparo) established by Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in those cases in which petitioners consider that the Administration’s physical actions, its administrative acts, or its response are affecting their fundamental rights.
In my view, the recently enacted legislation does not mean that this Court must modify its line of precedent, since, pursuant to section 7 of its Law, it has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances that may properly be heard in this jurisdiction through the constitutional guarantee proceeding of amparo, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 of 8:55 a.m. on February 22, 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction (jurisdicción de lo contencioso-administrativo). All of the foregoing is consistent with section 25 of the Convención Americana sobre Derechos Humanos, Constitutional Law (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
In environmental matters, it is my opinion that, if the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the contentious-administrative jurisdiction. Nevertheless, I do examine the merits of the matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy environment free of pollution (Article 50 of the Constitución Política), as occurs in this case, in which it is alleged that the respondent authorities have not resolved a complaint concerning improper water discharge and improper management of waste originating from a rooming house (cuartería), thereby endangering the appellant’s health and also threatening the right to enjoy a healthy and ecologically balanced environment and a dignified quality of life.
Although I agree with the majority of the Chamber that the appeal should be granted, I disagree as to the forum in which the enforcement phase (fase de ejecución) of the matter should be conducted, because the rules governing this constitutional jurisdiction do not provide adequate mechanisms for monitoring compliance with a judgment involving highly complex technical matters, as in this case, in which the Municipalidad de San Nombre02 and the Ministry of Health are required, within six months from notification of this judgment, to resolve the problem reported by the appellants concerning the alleged disposal of wastewater into a drainage ditch. By contrast, the enforcement provisions of the Código Procesal Contencioso-Administrativo (Article 155 et seq.) offer clear advantages, such as the ability to require schedules, impose fines, establish liability, monitor stages of compliance, and so forth. Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, these must be retrieved from the court office within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at Session N° 27-11, of August 22, 2011, Article XXVI, and published in the Boletín Judicial N° 19, of January 26, 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12, held on May 3, 2012, Article LXXXI.

The appeal is granted. Nixon Gerardo Ureña Guillén, Allan Francisco Artavia Jiménez, and Hermelink Johan Chinchilla Corrales, in their respective capacities as Alcalde Municipal, Coordinador del Área de Recursos Naturales, and Presidente del Concejo Municipal, all of the Municipalidad de San Ramón, as well as Eney Solís Soto, in his capacity as acting Director Regional of the Dirección Regional de Rectoría de la Salud Central Occidente del Ministerio de Salud, or whoever holds those offices, are ordered to take immediately the appropriate measures within the scope of their authority and to follow up on the complaint filed by the appellant. Furthermore, within SIX MONTHS from notification of this judgment, they must have resolved the problem, decided the complaint filed, and informed the appellants accordingly. The respondents are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or fined twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.
The State and the Municipalidad de San Nombre02 are ordered to pay the costs and damages caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment in the contentious-administrative jurisdiction. Justices Castillo Víquez and Salazar Alvarado submit separate notes. Justice Garro Vargas dissents regarding enforcement of this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, determines that it must be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in Articles 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be forwarded so that proceedings to enforce this ruling may be initiated. - Fernando Castillo V.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del dos de febrero de dos mil veinticuatro .
Recurso de amparo que se tramita en expediente número 23-030245-007-CO, interpuesto por [Nombre01 001], cédula de identidad [CED01], y [Nombre01 002], cédula de identidad [CED02], contra el MINISTERIO DE SALUD y la MUNICIPALIDAD DE SAN Nombre02 DE ALAJUELA.
Resultando:
Redacta el Magistrado Salazar Alvarado; y,
Considerando:
I.Objeto del recurso. La parte recurrente manifiesta, que desde el 28 de setiembre del 2023, se presentó una denuncia ante la Municipalidad y el Ministerio de Salud por el inadecuado vertimiento de aguas residuales (jabonosas y negras) en una acequia. Agrega, que pese a que dichos entes realizaron las inspecciones correspondientes y verificaron el problema, a la fecha no han actuado conforme a sus competencias, y no han puesto fin a la contaminación sanitaria..
II.Aclaración previa. Antes de analizar el fondo del asunto debe aclararse que, a partir de la Sentencia Nº 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones- aquellos asuntos en los que se discute si la Administración Pública ha cumplido o no los plazos razonablemente pautados para resolver las solicitudes planteadas por los administrados a la luz de lo dispuesto por el artículo 41, de la Constitución Política. En el caso concreto, se plantea un supuesto de excepción, pues, se plantea la supuesta falta de resolución de una solicitud para que se solucione un problema de vertedero de aguas negras a una acequia y que provoca malos olores que supuestamente afectan a los recurrentes y a su comunidad, lo que pone en peligro la vida y salud. Atendiendo a lo expuesto, se entra a resolver la situación concreta planteada en este recurso.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
A.- En cuanto a la Municipalidad de San Ramón:
B.- En relación con el Ministerio de Salud:
Único. Que a la fecha, la problemática denunciada por los recurrentes haya sido resuelta y comunicado lo correspondiente a los denunciantes.
V.Sobre el fondo. La Constitución Política, en el artículo 21, consagra la inviolabilidad de la vida humana, del cual se desprende el derecho a la salud y que, sin duda alguna, el mismo se encuentra íntimamente ligado al derecho de todas las personas a vivir en un ambiente sano y equilibrado, que contempla el artículo 50, constitucional. Frente a ese derecho surge para el Estado, la obligación de procurar una protección oportuna y adecuada a dichos derechos, a través de diversos entes y órganos, cada uno dentro del marco de sus respectivas competencias. Del estudio de los autos, y a partir de la relación de hechos probados, se tiene por acreditado, que desde el 28 de septiembre de 2023, la parte recurrente presentó, respectivamente, ante la Municipalidad y el Área de Salud, ambos del cantón de San Nombre02 una denuncia por una inadecuada disposición de aguas residuales a una acequia, dado la supuesta presencia de aguas negras y servidas, siendo que a la fecha, pese que ha trascurrido cuatro meses desde entonces, el problema no ha sido resuelto. Al respecto, se analizará cada de una de las actuaciones efectuadas en ese sentido por las autoridades recurridas.
VI.En cuanto a la Municipalidad de San Ramón. Es de mérito indicar, que corresponde a las municipalidades la administración de los intereses y servicios locales en cada cantón, de conformidad a lo dispuesto en el artículo 169, de la Constitución Política. De ahí se deriva la competencia de las municipalidades para planificar y vigilar el desarrollo urbano de su localidad. Esto incluye, el deber de establecer una política integral de planeamiento, que garantice un desarrollo urbano en congruencia con el funcionamiento eficiente de un sistema de provisión de agua potable y de recolección, tratamiento y disposición final de las aguas residuales. Igualmente, de lo anterior se deriva la obligación de adoptar las medidas requeridas para proveer al cantón de un adecuado sistema de alcantarillado pluvial, a fin garantizar a sus habitantes el derecho a la salud y a un ambiente libre de contaminación. En cuanto al tema específico de las obligaciones municipales en materia de alcantarillado pluvial, en Sentencia N°2008-04210, de las 13:59 horas del 14 de marzo de 2008, reiterada en la N° 2022000421, de las 09:15 horas del 07 de enero de 2022, esta Sala señaló:
“(…) Este Tribunal en jurisprudencia reiterada ha reconocido que el derecho a gozar de un ambiente sano y ecológicamente equilibrado es un derecho fundamental que deriva del artículo 50 Constitucional, según el cual, no sólo consagra el derecho de todo ciudadano a gozar de un medio ambiente sano y ecológicamente equilibrado, sino que además obliga al Estado a garantizar el ejercicio de dicho derecho, mediante los medios establecidos al efecto por la legislación vigente. Concretamente, tal como lo ha dicho esta Sala en la sentencia número 2005-009900 de las diez horas del veintinueve de julio del dos mil cinco debe la Municipalidad construir la infraestructura necesaria para hacer discurrir adecuadamente las aguas, para así garantizar el derecho a la salud y a un ambiente libre de contaminación y sin perjudicar a terceros: “(…) Sobre las obligaciones municipales en materia de alcantarillado pluvial.- Es conveniente tomar en cuenta que el artículo 169 de la Constitución Política establece que la administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal.
Los intereses y servicios locales han sido definidos por la Sala como conceptos jurídicos indeterminados donde la ley no resuelve con exactitud su contenido para su aplicación a casos concretos, por lo que resulta necesario acudir a criterios de valor y de experiencia, por parte de quien le corresponde aplicarlo, para determinar su contenido. La creación de medios de drenaje adecuados dentro de una comunidad a efectos de no causar daños a la propiedad, a la salud ni problemas de ambientales a sus vecinos es, dentro de los términos indicados por la Constitución Política, de interés del cantón y es parte de los servicios que la Municipalidad está en la obligación de brindar (…) Por tal motivo, la Municipalidad de Goicoechea, está obligada a asumir un determinado comportamiento para la satisfacción de sus fines, tomando las medidas requeridas para proveer a la comunidad amparada, de un sistema eficiente de drenaje de las aguas pluviales.
Ajustado a criterios de razonabilidad debe la Municipalidad construir la infraestructura necesaria para hacer discurrir adecuadamente esas aguas, para así garantizar el derecho a la salud y a un ambiente libre de contaminación y sin perjudicar a terceros”.
En el caso bajo estudio, desde el 06 de octubre de 2023, la autoridad recurrida comprobó, que las aguas que discurren por el alcantarillado denunciado y desembocan en una acequia presentan una coloración grisácea, característico de la presencia de aguas residuales, y que la identificación de las fuentes que descargan aguas ilegalmente al sistema colector de aguas pluviales, requieren de una intervención e investigación especial junto con el Ministerio de Salud, por lo que realizaron las coordinaciones necesarias para diseñar una propuesta para la atención de esta problemática. No obstante, han transcurrido cuatro meses y no han efectuado acto alguno para solucionar dicha situación. Nótese, que lo último que se hizo en relación con este caso, fue convocar a una reunión con funcionarios del Ministerio de Salud, la cual fue anulada y posterior a ello, no se desprende alguna actuación ya sea de manera individual o conjunta dirigida a solucionar el problema. De tal manera que, pese a que la Municipalidad recurrida ha tenido pleno conocimiento de los inconvenientes que afectan a los recurrentes y demás vecinos, ha omitido brindar una solución al grave problema que representa el desfogue de aguas negras a una acequia, por lo que impone la estimatoria de este extremo del recurso, con las consecuencias que se detallan en la parte dispositiva de esta resolución.
VII.En cuanto al Ministerio de Salud. En el sublite, la Sala tiene por demostrado, que una vez recibida la queja presentada por los recurrentes en el mes de setiembre de 2023, el 20 de octubre de ese año, realizó una visita al sitio y constató, que efectivamente, sobre el cordón pluvial de la Dirección01, discurren aguas que podrían provenir de un mal manejo en la disposición de las aguas residuales de las viviendas aledañas a la zona, las cuales conectan con una acequia. Se advierte, que la autoridad recurrida tiene conocimiento de dicho problema desde el año 2022, y pese a ello, lo que hizo fue acumular la denuncia de los recurrentes al expediente principal, siendo que posterior a la notificación del informe confeccionado a razón de la inspección, no le consta a la Sala, que haya efectuado o dictado algún acto administrativo con el fin de realizar la investigación respectiva, realizar los análisis correspondientes y si fuera el caso, girar las órdenes sanitarias.
Es decir, que desde hace más de dos meses, el expediente se encuentra inactivo siendo que se evidencia un desinterés en resolver la problemática denunciada. Nótese, que tan es así, que tampoco ha coordinado una reunión con los personeros de la Municipalidad de San Nombre02 para evaluar una solución en conjunto. En ese sentido, la Ley General de Salud, dispone en el artículo 355, que le corresponde al Ministerio de Salud ordenar y tomar las medidas especiales que habilita la ley para evitar el riesgo o daño a la salud de las personas o que éstos se difundan o se agraven y para inhibir la continuación o reincidencia en la perpetración de infracciones legales o reglamentarias que atenten contra la salud de las persona. Así las cosas, se constata que ha transcurrido cuatro meses aproximadamente, desde que la parte recurrente interpuso la denuncia, y a la fecha no ha recibido una resolución al respecto, pese a que la Municipalidad de San Ramón, les advirtió de la situación y los inconvenientes que ello está generando a la salud de los vecinos.
Se advierte, que la labor rectora del Ministerio de Salud no termina solo con una inspección del sitio denunciado, sino con el dictado de órdenes sanitarias, la notificación a la persona infractora y la obligación de verificar que las disposiciones ordenadas se cumplan a cabalidad, disponiendo para ello de los mecanismos que el ordenamiento jurídico le confiere para tales efectos. De modo, que resulta inaceptable, desde la óptica del Derecho Constitucional, que a la fecha no se haya resuelto la queja de los recurrentes ni dictado los actos pertinentes para solventar la problemática que aqueja a los vecinos, por lo cual se acredita la alegada lesión a los derechos fundamentales de la parte tutelada y de la comunidad.
VIII.Nota del Magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.
A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa que las autoridades recurridas no han resuelto una denuncia por un inadecuado desfogue de aguas y un mal manejo de residuos provenientes de una cuartería, lo que provoca un peligro para la salud de la parte recurrente, y también, una amenaza al derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso para que en el plazo de seis meses, contado a partir de la notificación de esta sentencia, se le dé solución por parte de la Municipalidad de San Nombre02 y el Ministerio de Salud a la problemática denunciada por los recurrentes por la acusada disposición de aguas residuales en una acequia. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Nixon Gerardo Ureña Guillén, Allan Francisco Artavia Jiménez, y Hermelink Johan Chinchilla Corrales, en su condición respectiva de Alcalde Municipal, Coordinador del Área de Recursos Naturales y Presidente del Concejo Municipal, ambos de la Municipalidad de San Ramón, así como a Eney Solís Soto, en su condición de Director Regional a.i. de la Dirección Regional de Rectoría de la Salud Central Occidente del Ministerio de Salud, o a quienes ocupen dichos cargos, que de forma inmediata tomen las medidas correspondientes en el ámbito de sus competencias, y brinden seguimiento a la denuncia presentada por la parte recurrente. Asimismo, dentro del plazo de SEIS MESES, a partir de la notificación de esta sentencia, deberán haber solucionado el problema, resuelto la queja interpuesta y comunicado a los recurrentes lo correspondiente. Se advierte a los recurridos que, de conformidad con lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Estado y a la Municipalidad de San Nombre02 al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Los magistrados Castillo Víquez y Salazar Alvarado consignan notas, de manera separada. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. - Fernando Castillo V.
