CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine fifteen a.m. on the nineteenth of January, two thousand twenty-four.

Application for amparo (recurso de amparo) processed under expediente número 23-030772-0007-CO, filed by [Nombre01 001], identity card [CED01], against the MINISTRY OF ENVIRONMENT AND ENERGY AND ANOTHER PARTY.

RESULTING:

  1. 1By a filing received by this Chamber at 18:45 hrs. on 11 de diciembre de 2023, the petitioner files an application for amparo and states that the law entitled “LAW FOR THE SUSTAINABLE DEVELOPMENT OF THE RÍO SARAPIQUÍ BASIN AND THE PROTECTION OF ITS MAIN CHANNEL” was enacted in official gazette La Gaceta no. 77 on jueves 28 de abril del 2022. The petitioner explains that this statute establishes vital safeguards to protect river ecosystems, biodiversity, and the rights of present and future generations. The petitioner adds that the first provision of the aforementioned law, which is linked to Article 50 of the Constitution, expressly provides as follows: “An environmental safeguard (salvaguarda ambiental) is hereby established along the entire main channel of the río Sarapiquí and its bank, from its source to its mouth at the río San Juan, for a renewable period of veinticinco años, for the purpose of maintaining it in the best ecological condition.While the environmental safeguard remains in effect, no new hydroelectric projects may be developed and no new concessions for the extraction of mineral materials may be granted.” The petitioner asserts that the aforementioned statute No. 10152 establishes an entire organization and allocation of interinstitutional responsibilities of great environmental value, as set forth in Articles 2, 3, 4, 5, 6 and 7. Likewise, the first transitory provision (transitorio primero) of said law states as follows: “The Executive Branch shall have a period of tres meses to issue regulations implementing this law.” The petitioner complains that the existing problem is that, as of this date—that is, more than 20 meses after its enactment—the indicated law has not been implemented by regulations, and consequently many environmental activities, functions, measures, and administrative procedures have been unable to take effect due to the lack of implementing regulations.To that extent, not only is there a violation of the obligations of the Executive Branch, but this also limits the realization of effective sustainable development for this and future generations. The petitioner reiterates that the application for amparo is filed against the Executive Branch, specifically against the Office of the President of the Republic and the Ministry of Environment and Energy, for failing to issue regulations implementing Law No. 10152, entitled LAW FOR THE SUSTAINABLE DEVELOPMENT OF THE RÍO SARAPIQUÍ BASIN AND THE PROTECTION OF ITS MAIN CHANNEL, a matter that violates, among other provisions, Article 50 of the Constitution in relation to Article 140, subsection 3), also of the Political Constitution, which establishes the duty of the Executive Branch to approve, enact, and issue regulations implementing laws.
  2. 2By an order issued at 10:48 hrs. on 19 de diciembre de 2023, the present application was admitted for processing, and the respondent authorities were notified on 20 de diciembre de 2023.
  3. 3In a filing submitted on 09 de enero de 2024, FRANZ TATTENBACH CAPRA, in his capacity as Minister of Environment and Energy, reports under oath that: “(…) As a first point, it is important to note that the available records show that the Comisión de Salvaguarda Rio Sarapiquí inquired about the status of the approval of the Regulations implementing Law N° 10152, ‘Law for the Promotion of Sustainable Development of the Río Sarapiquí Basin and the Protection of Its Main Channel.’ According to the official letter sent by [Nombre01 001], that Commission is coordinated by him. A response was provided through official letter DAJ-MINAE- 0992-2023 dated 05 de setiembre del 2023, notice of which was given on 6 de setiembre del 2023 at 14 horas 33 minutos to the email address [...], informing him that those regulations were undergoing the signature process before the Minister’s Office.

It is important to note that, although the official letter stated that those regulations were undergoing the signature process, they must be reviewed and approved by this Office. That review is currently being conducted to verify that everything set forth in the document includes all technical and legal requirements necessary to govern the application of Law N° 10152, Law for the Promotion of Sustainable Development of the Río Sarapiquí Basin and the Protection of Its Main Channel, which establishes a safeguard for the main channel of the Rio Sarapiquí, covering the following coordinates in the CRTM05 coordinate system for the affected river course: at its source, 487017 east and 1121935 north, and at its mouth at the Río San Juan, 507000 east and 1184766.

As a second and no less important point, it must be recalled that, among the duties and powers assigned to it by the Constitution in Article 140, the Executive Branch must enact laws, issue regulations implementing them, execute them, and ensure their exact observance; it must also issue such regulations as are appropriate for the internal administration of its offices and issue any other regulations and ordinances necessary for the prompt implementation of laws. In light of the foregoing, this Office states that the promulgation of the Regulations implementing Law N° 10152 is underway and that the public administration must comply with the law within the scope of the prohibitions established therein, in accordance with the Principle of Legality (Principio de Legalidad), which is grounded in Article 11 of the Political Constitution and the General Law of Public Administration (Ley General de la Administración Pública).

It is important to note that, once the Executive Decree containing the Regulations implementing Law N° 10152 is complete with everything required, this Minister’s Office will send it to the Office of the President of the Republic for the corresponding review and signature as soon as possible, after which it will be submitted for publication in official gazette La Gaceta.” The Minister requests that the application be denied.

  1. 4In a filing submitted on 09 de enero de 2024, NATALIA DÍAZ QUINTANA, in her capacity as Minister of the Presidency, reports under oath that: “(…) it is indeed the case that, on 28 de abril del año 2022, the ‘Law for the Sustainable Development of the Río Sarapiquí Basin and the Protection of Its Main Channel,’ Law N°10152, was published in official gazette La Gaceta.

According to the information provided by the authorities of the Ministry of Environment and Energy, the regulations implementing the cited law are still being drafted and validated by that Ministry. This establishes that the undersigned has not had and does not have any involvement whatsoever in the creation of those regulations, contrary to what the petitioner alleges.

In this regard, it must be made clear that the Ministry of the Presidency has no involvement in drafting the regulations implementing Law N°10152, because the technical body responsible for drafting them is the Ministry of Environment and Energy, in compliance with the legal system. Accordingly, that body is responsible for submitting the proposed regulations for review and signature by the President of the Republic. It should be noted that, in response to the request made of me, I join in the report submitted to this Honorable Authority through official letter DAJ-MINAE-0002-2024 dated 08 de enero de los corrientes, as well as the evidence provided by the Ministry of Environment and Energy.

Therefore, based on the facts and evidence presented, I respectfully request that this action against the party I represent be declared inadmissible.” She requests that the application filed be denied.

  1. 5In the processing of these proceedings, the requirements prescribed by law have been observed.

Justice Cruz Castro drafts the opinion; and,

Considering:

I. SUBJECT MATTER OF THE APPLICATION

The petitioner files an application for amparo and states that the law entitled “LAW FOR THE SUSTAINABLE DEVELOPMENT OF THE RÍO SARAPIQUÍ BASIN AND THE PROTECTION OF ITS MAIN CHANNEL” was enacted in official gazette La Gaceta no. 77 on jueves 28 de abril del 2022. The petitioner explains that this statute establishes vital safeguards to protect river ecosystems, biodiversity, and the rights of present and future generations. The petitioner adds that the first provision of the aforementioned law, which is linked to Article 50 of the Constitution, expressly provides as follows: “An environmental safeguard is hereby established along the entire main channel of the río Sarapiquí and its bank, from its source to its mouth at the río San Juan, for a renewable period of veinticinco años, for the purpose of maintaining it in the best ecological condition. II. PROVEN FACTS

The following facts are deemed duly established and relevant to the adjudication of this matter, either because they have been proven or because the respondent authority failed to address them, as required by the initial order:

1. On 28 de abril de 2022, the “Law for the Sustainable Development of the Río Sarapiquí Basin and the Protection of Its Main Channel,” Law N°10152, was published in official gazette La Gaceta (undisputed fact).

2. The regulations implementing Law N°10152 are being drafted and reviewed by the Ministry of Environment and Energy. Once the Executive Decree containing the Regulations implementing Law N° 10152 is complete with everything required, it will be sent to the Office of the President of the Republic for the corresponding review and signature as soon as possible, after which it will be submitted for publication in official gazette La Gaceta (see the report submitted by the respondent authorities).

III. REGULATORY OMISSIONS THAT INFRINGE THE LAW OF THE CONSTITUTION

With respect to judicial review of regulatory omissions (omisiones reglamentarias) that infringe the Law of the Constitution (Derecho de la Constitución), the Chamber has established the Executive Branch’s obligation to exercise its regulatory authority (potestad reglamentaria). One example is judgment N°101-90 issued at 14:30 hrs. on 30 de octubre de 1990, which stated, insofar as relevant:

“…the case is different when the legislature expressly imposes upon it by law the duty to issue regulations thereunder. Here, the exercise of that authority by the Executive Branch becomes inescapable. Within the unlimited scope of legislation, the party subject to a duty to act is the Executive Branch and, as such, it is bound by the order contained in the Law. All discretion disappears, since the legal provision has governed its conduct, making the exercise of that authority unavoidable. To the extent that it has departed from what was ordered, there is a constitutional violation, because, as is well known, the Executive Branch is subject to a dual obligation, being bound by both the Constitution and the Law. It cannot be understood, as has already been argued, that because regulatory authority (potestad reglamentaria) derives from the Constitución Política, the legislature is prohibited from regulating when that authority must be exercised.” It follows from the foregoing that the Executive Branch is subject to a dual obligation: to the law, on the one hand, and to the Constitution, on the other.

It is therefore evident that the Administration has no discretion to excuse itself from issuing regulations under a law when ordered to do so by the Legislature or the Constituent Assembly—also taking into account the scope of the principle of legality (principio de legalidad). It bears mentioning that Article 140, subsection 3), of the Constitución Política establishes the duty of the Executive Branch to assent to, promulgate, and issue regulations under laws. Accordingly, this provision is violated if the Executive Branch evades its obligation to issue regulations under laws, even when no other constitutional provision is affected. In other words, whenever there is a failure to issue regulations (omisión reglamentaria), the Executive Branch violates at least subsection 3) of Article 140, without prejudice to the possible violation of any other provision recognizing a right that is affected by that failure; in such cases, that failure is subject to review through a writ of amparo (recurso de amparo) if the inaction is connected with the enjoyment of a fundamental right; otherwise, review may always be sought through an action of unconstitutionality by omission (acción de inconstitucionalidad por omisión).

The foregoing demonstrates that the Executive Branch has no degree of discretion in cases where the Constitution or the law imposes upon it an obligation to issue regulations. In the last judgment quoted, the Sala Constitucional also stated:

“On the one hand, Article 11 of the Constitution has been violated insofar as it enshrines the public administration’s duty of legality, and by virtue of its text the Executive Branch cannot refuse to comply with a mandate contained in a duly promulgated law, because if it disagreed with its text, it could have exercised the veto reserved to it by the Constitución Política itself as an authority specific to the matter under consideration. Furthermore, upon assuming office and undertaking to comply with the laws through the constitutional oath (Article 194), the Presidente de la República and the respective Minister cannot subsequently, under arguments of any kind, decline to apply them with no possibility of correction, which is provided for in the current Ley de la Jurisdicción Constitucional through the action of unconstitutionality. The omissions underlying this proceeding also constitute a violation of subsection 3) of Article 140 of the Constitución Política, because the Executive Branch improperly refused to issue regulations under Law No. 6955 in its entirety.”

IV. THE SPECIFIC CASE

After analyzing the evidence submitted, this Court finds that the fundamental rights of the petitioner for amparo (amparada) were violated. The reports submitted by the representatives of the respondent authorities—which are deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter duly establish that, on 28 de abril de 2022, the “Ley para el desarrollo sostenible de la cuenca del Río Sarapiquí y la protección de su cauce principal”, Law N°10152, was published in the Diario Oficial La Gaceta. The respondent authorities, for their part, stated that the regulations under Law N°10152 are being drafted and reviewed by the Ministerio de Ambiente y Energía and that, once the Executive Decree containing the Regulations under Law N° 10152 is complete with everything required, it will be sent to the Office of the Presidente de la Republica for the corresponding review and signature as soon as possible, after which it will be submitted for publication in the Diario Oficial La Gaceta.

The factual basis established in this proceeding, as well as the statements in the precedent partially quoted above, reveal the alleged failure, which is attributable to the respondent authorities. In this regard, it should be noted that the “Ley para el desarrollo sostenible de la cuenca del Río Sarapiquí y la protección de su cauce principal”, Law N°10152, expressly provides as follows:

“TRANSITORY PROVISION I- The Executive Branch shall have a period of three months to issue regulations under this Law.” Accordingly, given that the time limit established by the legislature has elapsed and considering that the decree regulating the aforementioned Law has not yet been published, it is established that the respondent authorities have violated the provisions of Articles 50 and 140, subsection 3), of the Constitution. It must be recalled that the Executive Branch has no degree of discretion in cases where the Constitution or the law imposes upon it an obligation to issue regulations.

Consequently, the appropriate course is to grant the petition and order the Executive Branch to issue regulations under the “Ley para el desarrollo sostenible de la cuenca del Río Sarapiquí y la protección de su cauce principal”, Law N°10152, pursuant to Article 140, subsection 3), of the Constitución Política, within the period specified in the operative portion (parte dispositiva) of this judgment.

V. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

THEREFORE:

The petition is GRANTED. Consequently, NATALIA DÍAZ QUINTANA, in her capacity as Ministra de la Presidencia, and FRANZ TATTENBACH CAPRA, in his capacity as Ministro de Ambiente y Energía, are ordered to coordinate and make the necessary arrangements so that, within TWO MONTHS from notification of this judgment, they issue the Executive Decree implementing the Ley para el desarrollo sostenible de la cuenca del Río Sarapiquí y la protección de su cauce principal, Law N°10152, published in the Diario Oficial La Gaceta on 28 de abril del año 2022. They are hereby warned of the criminal consequences arising from disobedience of orders issued by this Jurisdiction, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional. The State is ordered to pay costs and damages, which shall be quantified during enforcement of the judgment before the contentious-administrative jurisdiction (jurisdicción de lo contencioso administrativo). Notice shall be served.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del diecinueve de enero de dos mil veinticuatro .

Recurso de amparo que se tramita en el expediente número 23-030772-0007-CO interpuesto por [Nombre01 001], cédula de identidad [CED01], contra el MINISTERIO DE AMBIENTE Y ENERGÍA Y OTRO.

RESULTANDO:

  1. 1Por escrito recibido en esta Sala a las 18:45 hrs. del 11 de diciembre de 2023, la parte recurrente presenta recurso de amparo y expone que, en el diario oficial La Gaceta no. 77, del jueves 28 de abril del 2022 se promulgó la denominada "LEY PARA EL DESARROLLO SOSTENIBLE DE LA CUENCA DEL RÍO SARAPIQUÍ Y LA PROTECCIÓN DE SU CAUCE PRINCIPAL". Aclara que dicha norma establece salvaguardas vitales para proteger los ecosistemas fluviales, a la biodiversidad y a los derechos de la presente y futuras generaciones. Añade que la norma primera de la ley señalada, que está vinculada al numeral 50 constitucional, dispone expresamente lo siguiente: "Se declara una salvaguarda ambiental a todo lo largo del cauce principal del río Sarapiquí y su ribera, desde su nacimiento hasta la desembocadura en el río San Juan, por un periodo de veinticinco años prorrogables, con la finalidad de mantenerlo en las mejores condiciones ecológicas.Durante la vigencia de la salvaguarda ambiental no podrán desarrollarse nuevos proyectos hidroeléctricos ni otorgar nuevas concesiones de extracción de materiales mineros". Afirma que la norma en mención No. 10152, genera toda una organización y distribución de responsabilidades interinstitucionales de gran valor ambiental, tal y como se desarrolla en los numerales 2, 3, 4, 5, 6 y 7. Igualmente, en el transitorio primero de la ley dicha señala lo siguiente: "El Poder Ejecutivo tendrá un periodo de tres meses para reglamentar la presente ley". Reclama que el problema existente es que, a la fecha, es decir, a más 20 meses de su promulgación, la ley indicada no ha sido reglamentada, por lo que muchas actividades, funciones y gestiones ambientales y de procedimientos administrativos no se han podido materializar por falta de reglamentación y en ese tanto, incluso no solo estamos ante una violación de obligaciones del Poder Ejecutivo, sino que ello limita la materialización de un desarrollo sostenible efectivo para esta y las generaciones futuras.Reitera que presenta el recurso de amparo contra el Poder Ejecutivo, propiamente contra la Presidencia de la Republica y el Ministerio de Ambiente y Energía, por no reglamentar la ley No. 10152, denominada LEY PARA EL DESARROLLO SOSTENIBLE DE LA CUENCA DEL RÍO SARAPIQUÍ Y LA PROTECCIÓN DE SU CAUCE PRINCIPAL, asunto que violenta entre otros la norma 50 constitucional en relación con el artículo 140 inciso 3) también de la Constitución Política, que establece el deber del Poder Ejecutivo de sancionar, promulgar y reglamentar las leyes.
  2. 2Mediante auto de las 10:48 hrs. del 19 de diciembre de 2023 se dio curso al presente recurso y se notificó a las autoridades recurridas el 20 de diciembre de 2023.
  3. 3Por escrito presentado el 09 de enero de 2024, informa bajo juramento FRANZ TATTENBACH CAPRA, en condición de Ministro de Ambiente y Energía que: “(…) Como primero punto es importante señalar que dentro de los registros que se tienen, se encuentra que la Comisión de Salvaguarda Rio Sarapiquí, consultó sobre el estado de la aprobación del Reglamento a la Ley N° 10152, “Ley para La Promoción del Desarrollo Sostenible de La Cuenca del Río Sarapiquí y La Protección de su Cauce Principal, dicha Comisión está coordinada según el oficio enviado por el señor [Nombre01 001], al cual se le respondió mediante oficio DAJ-MINAE- 0992-2023 del 05 de setiembre del 2023, notificado el 6 de setiembre del 2023 a las 14 horas 33 minutos al correo electrónico [...], señalándole que dicho reglamento se encontraba en trámite de firma ante el despacho ministerial.

Es importante señalar que, si bien es cierto, en el oficio sé indicó que dicho reglamento estaba en el trámite en proceso de firma, el mismo debe ser revisado y aprobado por este despacho, lo cual se está realizando en momento, se está verificando que todo lo plasmado en el documento contemple lo requerido técnico y jurídicamente necesario para regular la aplicación de la Ley N° 10152 Ley para La Promoción del Desarrollo Sostenible de La Cuenca del Río Sarapiquí y La Protección de su Cauce Principal, que tiene una salvaguarda del cauce principal del Rio Sarapiquí, de las siguientes coordenadas en el sistema de coordenadas CRTM05 del curso de rio afectado: para su nacimiento 487017 este y 1121935 norte y la desembocadura al Río San Juan en 507000 este y 1184766.

Como segundo punto y no menos importante, es necesario traer a colación que el Poder Ejecutivo tiene dentro de sus deberes y atribuciones establecidas en la Carta Magna en su artículo 140 promulgar las leyes, reglamentarlas, ejecutarlas y velar por su exacto cumplimiento; así como dar el Reglamento que convenga para el régimen interior de sus despachos, y expedir los demás reglamentos y ordenanzas necesarios para la pronta ejecución de las leyes; por lo antes expuesto, es que este Despacho señala que la promulgación del Reglamento a la Ley N° 10152 se encuentra en trámite y la administración pública deberá acatar lo que indica la ley bajo el alcance de las prohibiciones establecidas en la misma, acogiendo al Principio de Legalidad, el cual tiene fundamento en el artículo 11 de la Constitución Política y de la Ley General de la Administración Pública.

Importante señalar que una vez que el Decreto Ejecutivo Reglamento a la Ley N° 10152, esté listo con todo lo que se requiere, este despacho ministerial lo estará enviando al Despacho del señor Presidente de la Republica para la revisión y firma correspondiente en el menor plazo posible, para luego ser enviado a publicar en el Diario Oficial La Gaceta.”. Solicita se desestime el recurso.

  1. 4Por escrito presentado el 09 de enero de 2024, informa bajo juramento NATALIA DÍAZ QUINTANA, en condición de Ministra de la Presidencia que: “(…) en efecto el 28 de abril del año 2022, se publicó en el Diario Oficial La Gaceta, la “Ley para el desarrollo sostenible de la cuenca del Río Sarapiquí y la protección de su cauce principal”, Ley N°10152.

De acuerdo con lo informado por las autoridades del Ministerio de Ambiente y Energía, el reglamento a la ley de cita aún se encuentra en trámite de elaboración y validación por parte de tal instancia Ministerial, aspecto que permite acreditar que la suscrita no ha tenido ni tiene injerencia alguna en la creación de dicha normativa, tal y como al efecto lo reclama la parte accionante.

Al respecto, se hace necesario evidenciar que el Ministerio de la Presidencia, no tiene incidencia en la elaboración del reglamento a la ley N°10152, dado que la instancia técnica encargada de elaborarlo es el Ministerio de Ambiente y Energía, en cumplimiento a lo establecido por el ordenamiento jurídico. En este sentido, corresponde a dicha instancia remitir la propuesta reglamentaria, para revisión y firma del señor Presidente de la República. Es oportuno indicar que, ante la solicitud que me ha sido requerida, me adhiero al informe rendido ante su Honorable Autoridad mediante oficio DAJ-MINAE-0002-2024 de fecha 08 de enero de los corrientes, así como a las pruebas aportadas por el Ministerio de Ambiente y Energía.

Así las cosas, conforme a los hechos y las pruebas expuestas, respetuosamente solicito se declare como improcedente la presente acción en contra de mi representada.” Solicita se desestime el recurso planteado.

  1. 5En la substanciación de este proceso se han observado las prescripciones de ley.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I. OBJETO DEL RECURSO

La parte recurrente presenta recurso de amparo y expone que, en el diario oficial La Gaceta no. 77, del jueves 28 de abril del 2022 se promulgó la denominada "LEY PARA EL DESARROLLO SOSTENIBLE DE LA CUENCA DEL RÍO SARAPIQUÍ Y LA PROTECCIÓN DE SU CAUCE PRINCIPAL". Aclara que dicha norma establece salvaguardas vitales para proteger los ecosistemas fluviales, a la biodiversidad y a los derechos de la presente y futuras generaciones. Añade que la norma primera de la ley señalada, que está vinculada al numeral 50 constitucional, dispone expresamente lo siguiente: "Se declara una salvaguarda ambiental a todo lo largo del cauce principal del río Sarapiquí y su ribera, desde su nacimiento hasta la desembocadura en el río San Juan, por un periodo de veinticinco años prorrogables, con la finalidad de mantenerlo en las mejores condiciones ecológicas. Durante la vigencia de la salvaguarda ambiental no podrán desarrollarse nuevos proyectos hidroeléctricos ni otorgar nuevas concesiones de extracción de materiales mineros".

Afirma que la norma en mención No. 10152, genera toda una organización y distribución de responsabilidades interinstitucionales de gran valor ambiental, tal y como se desarrolla en los numerales 2, 3, 4, 5, 6 y 7. Igualmente, en el transitorio primero de la ley dicha señala lo siguiente: "El Poder Ejecutivo tendrá un periodo de tres meses para reglamentar la presente ley". Reclama que el problema existente es que, a la fecha, es decir, a más 20 meses de su promulgación, la ley indicada no ha sido reglamentada, por lo que muchas actividades, funciones y gestiones ambientales y de procedimientos administrativos no se han podido materializar por falta de reglamentación y en ese tanto, incluso no solo estamos ante una violación de obligaciones del Poder Ejecutivo, sino que ello limita la materialización de un desarrollo sostenible efectivo para esta y las generaciones futuras. Reitera que presenta el recurso de amparo contra el Poder Ejecutivo, propiamente contra la Presidencia de la Republica y el Ministerio de Ambiente y Energía, por no reglamentar la ley No. 10152, denominada LEY PARA EL DESARROLLO SOSTENIBLE DE LA CUENCA DEL RÍO SARAPIQUÍ Y LA PROTECCIÓN DE SU CAUCE PRINCIPAL, asunto que violenta entre otros la norma 50 constitucional en relación con el artículo 140 inciso 3) también de la Constitución Política, que establece el deber del Poder Ejecutivo de sancionar, promulgar y reglamentar las leyes.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

1. El 28 de abril de 2022, se publicó en el Diario Oficial La Gaceta, la “Ley para el desarrollo sostenible de la cuenca del Río Sarapiquí y la protección de su cauce principal”, Ley N°10152 (hecho no controvertido).

2. El reglamento de la Ley N°10152 se encuentra en proceso de elaboración y revisión por parte del Ministerio de Ambiente y Energía y una vez que el Decreto Ejecutivo Reglamento a la Ley N° 10152, esté listo con todo lo que se requiere, será enviado al Despacho del señor Presidente de la Republica para la revisión y firma correspondiente en el menor plazo posible, para luego ser enviado a publicar en el Diario Oficial La Gaceta (ver informe rendido por parte de las autoridades accionadas).

III. SOBRE LAS OMISIONES REGLAMENTARIAS QUE LESIONAN EL DERECHO DE LA CONSTITUCIÓN

En cuanto al tema del control de las omisiones reglamentarias que lesionan el Derecho de la Constitución, la Sala ha sentado la obligación del Poder Ejecutivo de ejercer su potestad reglamentaria. Un ejemplo de lo anterior es la sentencia N°101-90 de las 14:30 hrs. de 30 de octubre de 1990, la cual señaló en lo conducente:

“…distinto es el caso en el cual el legislador expresamente le impone en la ley el deber de reglamentarla. Aquí se hace inescapable para el Poder Ejecutivo el ejercicio de esa competencia. Dentro del ilimitado espacio de la legislación, aquí el destinatario de un deber hacer es el Poder Ejecutivo y, como tal, queda sujeto a la orden contenida en la Ley. Desaparece para él toda discrecionalidad, pues la norma legal regló su actuación, de modo que el ejercicio de la competencia se hace inevitable. En el tanto se haya apartado de lo ordenado, en ese tanto hay una infracción constitucional, pues como se sabe, el Poder Ejecutivo tiene una doble sumisión al estar sujeto a la Constitución y a la Ley. No es dable entender, como ya se ha intentado, que, derivada la potestad reglamentaria de la Constitución Política, el legislador tiene vedado el regular la oportunidad de su ejercicio.” De lo anterior se deduce que existe una doble vinculación del Poder Ejecutivo, por un lado, a la ley y por otro a la Constitución.

Por ello, es evidente que la Administración no cuenta con discrecionalidad alguna para excusarse de reglamentar una ley si así ha sido ordenado por el Legislador o por el Constituyente –teniendo en cuenta, asimismo, los alcances del principio de legalidad-. Cabe mencionar que el artículo 140 inciso 3) de la Constitución Política establece el deber del Poder Ejecutivo de sancionar, promulgar y reglamentar las leyes. Por ese motivo, este precepto resulta vulnerado si el Poder Ejecutivo soslaya su obligación de reglamentar las leyes, aún cuando no se afecta otra norma constitucional. Es decir, en todos los casos en que exista una omisión reglamentaria, el Poder Ejecutivo lesiona al menos el inciso 3) del artículo 140, eso sin contar la posible vulneración a cualquier otra norma que reconozca un derecho y que se vea afectada por esa omisión; en tales casos, dicha omisión es susceptible de control por la vía del recurso de amparo si esa inactividad está vinculada al disfrute de un derecho fundamental; de no ser así, siempre se puede efectuar el control por la vía de la acción de inconstitucionalidad por omisión.

Lo anterior, evidencia que el Poder Ejecutivo no cuenta con ningún grado de discrecionalidad en los casos en que la Constitución o la ley le establecen una obligación de reglamentar. En la última sentencia transcrita la Sala Constitucional también señaló:

“Por una parte, el artículo 11 constitucional ha sido violado en el tanto en que en él se consagra el deber de legalidad de la administración pública y por virtud de su texto el Poder Ejecutivo no puede negarse a cumplir un mandato contenido en una ley debidamente promulgada, ya que si no estaba de acuerdo con su texto, pudo ejercer el veto que le reserva la misma Constitución Política como una atribución propia y específica al caso en estudio. Además, al asumir funciones, y obligarse a cumplir las leyes, por el juramento Constitucional (artículo 194) el Presidente de la República y el Ministro respectivo no pueden, posteriormente, bajo argumentos de ninguna especie, desaplicarlas sin que haya posibilidad de enmienda, lo que se prevé en la actual Ley de la Jurisdicción Constitucional, con la acción de inconstitucionalidad. Por las omisiones base de este proceso, asimismo, existe una infracción a lo dispuesto por el inciso 3) del artículo 140 de la Constitución. Política, pues el Poder Ejecutivo en forma indebida se negó a reglamentar la ley No. 6955 en su totalidad.”

IV. SOBRE EL CASO CONCRETO

Después de analizar los elementos probatorios aportados, este Tribunal verifica la lesión a los derechos fundamentales de la amparada. De los informes rendidos por los representantes de las autoridades recurridas -que se tienen dados bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, el 28 de abril de 2022, se publicó en el Diario Oficial La Gaceta, la “Ley para el desarrollo sostenible de la cuenca del Río Sarapiquí y la protección de su cauce principal”, Ley N°10152. Por su parte, las autoridades accionadas indicaron que, el reglamento de la Ley N°10152 se encuentra en proceso de elaboración y revisión por parte del Ministerio de Ambiente y Energía y una vez que el Decreto Ejecutivo Reglamento a la Ley N° 10152, esté listo con todo lo que se requiere, será enviado al Despacho del señor Presidente de la Republica para la revisión y firma correspondiente en el menor plazo posible, para luego ser enviado a publicar en el Diario Oficial La Gaceta.

De la base fáctica acreditada en este proceso, así como, de lo indicado en el precedente parcialmente transcrito, se aprecia la acusada omisión, la cual le es atribuible a las autoridades recurridas. En ese sentido, se advierte que la “Ley para el desarrollo sostenible de la cuenca del Río Sarapiquí y la protección de su cauce principal”, Ley N°10152, dispone expresamente lo siguiente:

“TRANSITORIO I- El Poder Ejecutivo tendrá un periodo de tres meses para reglamentar la presente ley.” Así las cosas, al constatarse que el plazo dispuesto por el legislador ha sido superado y considerando que aún no se ha publicado el decreto para la regulación de indicada ley, se acredita que las autoridades accionadas lesionan lo preceptuado en los ordinales 50 y 140 inciso 3) de la Constitución. Debe recordarse que, el Poder Ejecutivo no cuenta con ningún grado de discrecionalidad en los casos en que la Constitución o la ley le establecen una obligación de reglamentar.

Consecuentemente, lo procedente es declarar con lugar el recurso, ordenando al Poder Ejecutivo, la reglamentación de la “Ley para el desarrollo sostenible de la cuenca del Río Sarapiquí y la protección de su cauce principal”, Ley N°10152, de conformidad con lo dispuesto en el artículo 140 inciso 3) de la Constitución Política, dentro del plazo indicado en la parte dispositiva de esta sentencia.

V. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara CON LUGAR el recurso. Consecuentemente, se ordena a NATALIA DÍAZ QUINTANA, en condición de Ministra de la Presidencia y a FRANZ TATTENBACH CAPRA, en condición de Ministro de Ambiente y Energía, que coordinen y dispongan lo necesario para que, en el plazo de DOS MESES, contado a partir de la notificación de esta sentencia, dicten el Decreto Ejecutivo para la implementación de la Ley para el desarrollo sostenible de la cuenca del Río Sarapiquí y la protección de su cauce principal, Ley N°10152, publicada en el Diario Oficial La Gaceta el 28 de abril del año 2022. Lo anterior bajo apercibimiento de las consecuencias penales que se desprenden por la desobediencia a las órdenes dictadas por esta Jurisdicción, artículo 71 de la Ley de la Jurisdicción Constitucional. Se condena al Estado al pago de costas, daños y perjuicios, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese.
