PJEDITOR Document Decision No. 2024000400 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine fifteen a.m. on January twelfth, two thousand twenty-four.

Amparo proceeding (recurso de amparo) filed by [Nombre01 001], identity card number [CED01], against the Municipalidad de Cartago.

BACKGROUND:

  1. 1In a brief added to this case file on October 11, 2023, the petitioner alleged, in summary, that on August 4, 2023, he submitted a request for information to the Concejo Municipal de Cartago concerning the Los Pinos sanitary landfill (located in Navarro de Dulce Nombre01 de Cartago). However, he has not been provided with the requested information.
  2. 2By decision issued at 9:31 a.m. on November 8, 2023, the proceeding was admitted.
  3. 3In a brief added to this case file on November 15, 2023, Jonathan Arce Moya, Presidente Municipal de Cartago, submitted his report. He stated the following:

“As shown by the attached certified documentation, the municipality is duly processing the request for information that the petitioner alleges in this proceeding has gone unanswered; to the contrary, this matter has not been concluded for reasons attributable to him, since he failed to respond to the opportunity to be heard (audiencia) granted by the Concejo. As shown in Article 9 of Minutes 271-2023 of September 19, 2023, it was decided to accept the technical recommendation, and consequently it was resolved:

‘…to grant both parties a period of 10 business days to submit written, detailed, and specific statements: Mr. [Nombre01 002], regarding the statements made by Ms. [Nombre01 006]…’ It follows from the foregoing that none of the petitioner’s constitutional rights has been violated; therefore, this action should be dismissed.”

  1. 4In a brief added to this case file on November 18, 2023, the petitioner replied to the report. He stated that, instead of providing him with the information, the Concejo expects him to appear. He alleges that the municipal administration has not informed the Concejo of the environmental damage caused by the Los Pinos sanitary landfill. In his view, the Concejo offers excuses instead of providing the information. He further states that on the same day the Concejo considered his request, WPP Continental, the company that operates the sanitary landfill, submitted a letter disputing what he had requested. He emphasizes that he has not received the information, even though he insisted on October 16, 2023, that it be provided to him.
  2. 5By decision issued at 1:33 p.m. on November 21, 2023, this amparo proceeding was expanded to include the Alcalde Municipal de Cartago.
  3. 6In a brief added to this case file on December 19, 2023, Mario Redondo Poveda, Alcalde Municipal de Cartago, submitted his report. He stated the following:

“I, the undersigned Alcalde Municipal de Cartago, as demonstrated by the attached certification, hereby address this amparo proceeding in connection with the order issued at 1:33 p.m. on November 21, 2023, as follows:

I agree in all respects with, adopt as my own, and reiterate what the Presidente previously reported and demonstrated to this esteemed Chamber in connection with the amparo proceeding at issue:

‘…As shown by the attached certified documentation, the municipality is duly processing the request for information that the petitioner alleges in this proceeding has gone unanswered; to the contrary, this matter has not been concluded for reasons attributable to him, since he failed to respond to the opportunity to be heard granted by the Concejo. As shown in Article 9 of Minutes 271-2023 of September 19, 2023, it was decided to accept the technical recommendation, and consequently it was resolved:

‘…to grant both parties a period of 10 business days to submit written, detailed, and specific statements: Mr. [Nombre01 002], regarding the statements made by Ms. [Nombre01 006]…’ Indeed, improperly and in an effort to mislead this Court, the petitioner omits the obvious fact that the resolution in which he is interested, namely, the resolution contained in Article No. 19 of Minutes No. 260 from the session of August 8, 2023, predates the resolution supporting the response submitted to the Chamber by the Presidente del Concejo, namely, the resolution contained in Article 9 of Minutes 271-2023 of September 19, 2023. The former was therefore superseded by the latter, and the most recent resolution prevails. As shown by the documentation submitted with the Presidente’s report, that resolution did NOT require a report from the Administration, but instead resolved:

‘…to grant both parties a period of 10 business days to submit written, detailed, and specific statements: Mr. [Nombre01 002], regarding the statements made by Ms. [Nombre01 006]…’ It bears emphasizing that, as of today, the petitioner has NOT responded to the opportunity to be heard unanimously granted to him by the Concejo, which prevents a final decision on the brief in which he is interested. As shown in the aforementioned resolution contained in Article 9 of Minutes 271-2023 of September 19, 2023, both his initial brief and a brief from a third party—Ms. [Nombre01 004], Representante Legal WPP Continental Los Pinos S.A.—were considered at that session and in that resolution, requiring the Concejo to obtain statements from both parties on the matter:

‘ARTICLE 9.- REPORT ON ARTICLE 19 OF MINUTES 206-2023, REQUEST SUBMITTED TO THE CONCEJO MUNICIPAL FOR INFORMATION CONCERNING THE LOS PINOS SANITARY LANDFILL BY MR. [Nombre01 001], AND ON ARTICLE 34 OF MINUTES 262-2023, OFFICIAL LETTER CONCERNING MR. [Nombre01 001]’S REQUEST FOR INFORMATION, SUBMITTED BY MS. [Nombre01 005], REPRESENTANTE LEGAL WPP CONTINENTAL LOS PINOS S.A.’ Moreover, a simple reading of that most recent resolution shows that the brief which the petitioner alleges went unanswered was even addressed and considered at that session by the Administration’s technical staff:

Official Letter AM-lNF-281-2023 dated September 04, 2023, signed by Lic. Mario Redondo Poveda Alcalde Municipal, is considered, whereby he forwards Official Letter AL-OF-4012023/AOM-OF-124-2023 dated August 25, 2023, signed by MSC. Wilberth Quesada Garita Director Jurídico a.i. and Ing. Jorge Araya Serrano Encargado área de operaciones, which states: Regarding the matter cited in the reference, we report as follows:

That technical official letter was approved by the Concejo in that resolution:

Presidente Arce Moya proposes waiving committee review, submits the matter for discussion, and, following sufficient discussion, submits it to a vote, resulting in seven affirmative votes from council members Nombre02, Nombre03, Brenes Figueroa, Guzmán Castillo, Torres Céspedes, Halabí Fauaz, and Arce Moya; Víquez Sánchez and Madriz Jiménez vote against; committee review is waived. The Presidente proposes accepting Report AL-OF-401-2023fAOM-OF-124-2023, submits the matter for discussion, and, following sufficient discussion, submits it to a vote. By the unanimous affirmative vote of all nine council members—Nombre02, Nombre03, Víquez Sánchez, Madriz Jiménez, Brenes Figueroa, Guzmán Castillo, Torres Céspedes, Halabí Fauaz, and Arce Moya—it is resolved to accept Report AL-OF-401-2023/AOM-OF-124-2023; therefore, both parties are granted a period of 10 business days to submit written, detailed, and specific statements: Mr. [Nombre01 002], regarding the statements made by Ms. [Nombre01 006], and said woman, as to whether she wishes to respond specifically to each inquiry submitted by Mr. [Nombre01 002] to this Concejo, given her status as legal representative of WPP Continental Los Pinos S.A. By the unanimous affirmative vote of all nine council members—Nombre02, Nombre03, Víquez Sánchez, Madriz Jiménez, Brenes Figueroa, Guzmán Castillo, Torres Céspedes, Halabí Fauaz, and Arce Moya—it is resolved to declare it final. Notice of this resolution shall be served, with acknowledgment and date of receipt, on Mr. [Nombre01 001] at the email address [...], Ms. [Nombre 004], Representante Legal WPP Continental Los Pinos SA., at the email address [...], and Lic. Mario Redondo Poveda Alcalde Municipal. Resolution finally approved.

Thus, it bears emphasizing that not only has the official letter in which the petitioner is interested already been answered, but his own lack of diligence is also the reason why the matter has NOT been finally decided.

As evidence of all the foregoing, I refer to the evidence submitted by the Presidente del Concejo.”

  1. 7In a brief added to this case file on December 26, 2023, the petitioner replied to the reports and reiterated his request that this amparo proceeding be granted.
  2. 8The legal requirements have been observed in the proceedings conducted.

Justice Cruz Castro writes the opinion; and,

Considering:

I. SUBJECT MATTER

The petitioner alleged that on August 4, 2023, he submitted a request for information to the Concejo Municipal de Cartago concerning the Los Pinos sanitary landfill (located in Navarro de Dulce Nombre01 de Cartago). However, he has not been provided with the requested information.

II. PROVEN FACTS

The following facts are deemed duly established and relevant to the decision in this matter:

  • 1)On August 4, 2023, the petitioner requested the following information from the Concejo Municipal de Cartago:

“1. Is this Concejo Municipal aware of the current condition of the Los Pinos sanitary landfill located in Navarro de Dulce Nombre01 de Cartago? 2. Are you aware whether SETENA has granted environmental approval (viabilidad ambiental) for the new site that the company is operating? 3. Does the operating health permit (permiso sanitario de funcionamiento) issued in 2018 by the Ministerio de Salud (MINSA) de Cartago to the operating company retained by this Municipality apply to the area belonging to the operating company, or only to the land occupied by the former dump? 4. Is this Concejo Municipal aware of the useful life of the former dump? 5. Does the operating company receive waste from locations far from Cartago, and who authorized it to do so? 6. Are you aware whether the operating company is depositing waste on the property belonging to that company, located beside the former dump, and whether it has the approval of SETENA, the Municipalidad de Cartago, and the Ministerio de Salud Cartago? 7.

If so, under what criteria were those permits granted? 8. Does this Municipality have LEACHATE AND GROUNDWATER CHARACTERIZATION STUDIES (ESTUDIOS DE CARACTERIZACION DE LIXIVIADOS Y LAS AGUAS SUBTERRANEAS) FOR THE LOS PINOS DUMP (NAVARRO)? If so, I respectfully request that I be provided with copies of those studies for the last 3 months. 9. Are there design plans for the post-closure works once the technical closure works for the former dump have been completed? 10. Are you aware of the DAILY TONNAGE entering that sanitary landfill? 11. I also request the tonnage intake report for the last three months of 2023. 12. Has this Municipality approved any design change on the land belonging to this Municipality under the contract between this Municipality and the company operating the site? 13. Has the operating company submitted any preliminary plan or schedule for the final closure of the Los Pinos sanitary landfill? 14.

Are you aware whether the company operating the Los Pinos landfill has submitted any post-closure plan for that location? 15. If there has been any design change to the Los Pinos sanitary landfill, when was it accepted by this Municipality, and which officials approved it? 16. A copy of Report CNEUIAR-INF-0519-2019 issued by Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE), which is contained in the Los Pinos sanitary landfill case file” (copy submitted).

  • 2)On 16 de agosto del 2023, the Council notified the appellant of the decision adopted in connection with his request at the Ordinary Session held on 8 de agosto del 2023, Minutes Nº 260-2023, Article Nº19, which states as follows:

“President Arce Moya proposes referring the matter to the Administration; he submits the opinion for discussion; following sufficient discussion, he submits it to a vote; it is unanimously resolved, with nine affirmative votes from council members Nombre02, Nombre03, Víquez Sánchez, Madriz Jiménez, Brenes Figueroa, Guzmán Castillo, Torres Céspedes, Halabí Fauaz and Arce Moya, to refer the matter to the Administration” (copy submitted).

  • 3)On 28 de setiembre del 2023, the Council notified the appellant of the decision adopted at the Ordinary Session held on 19 de setiembre del 2023, Minutes Nº 271-2023, Article Nº9, which states as follows:

“… it is unanimously resolved, with nine affirmative votes from council members Nombre02, Nombre03, Víquez Sánchez, Madriz Jiménez, Brenes Figueroa, Guzmán Castillo, Torres Céspedes, Halabí Fauaz and Arce Moya, to adopt report AL-OF-401-2023/AOM-OF-124-2023; therefore, both parties are granted a period of 10 business days to provide, in writing and in a detailed and specific manner, their respective statements: Mr. [Nombre01 002] regarding the statements made by Ms. [Nombre01 006], and said woman as to whether she wishes to respond specifically to each inquiry that Mr. [Nombre01 002] has submitted to this Council, considering her capacity as legal representative of WPP Continental Los Pinos S.A.” (documentation submitted).

III. UNPROVEN FACTS

The following fact of importance to the resolution of these proceedings is deemed unproven: Sole fact.- That the Council had provided the requested information.

IV.Right of petition (derecho de petición) and access to public information (acceso a la información pública). With respect to the violation of the right of petition, it should be noted that Article 27 of the Constitución Política enshrines the public subjective right (derecho subjetivo público) of every person, whether natural or legal, to petition any public body or entity concerning a matter of interest, to which the Administration must respond promptly, reasonably, consistently, effectively, and within a short period. The right of petition may be exercised individually or collectively and, moreover, does not require a legitimate or subjective interest, since it derives from the State’s own obligations toward those subject to its administration. Consistent with these principles, the case law of this Sala Constitucional has clearly established that when a person submits a request for information to a public agency, the agency must at all times comply with the established response periods, all in accordance with Article 27 of the Constitución Política, in conjunction with Article 32 of the Ley de la Jurisdicción Constitucional. Furthermore, Article 30 of the Constitución Política provides as follows:

«ARTICLE 30.- Free access to administrative departments is guaranteed for the purpose of obtaining information on matters of public interest.

State secrets are excepted».

Furthermore, this Chamber has specified that this right refers to situations involving straightforward requests for information. The situation is different when an interested party asks the Administration to correct what the party considers to be an error or, more generally, asks the Administration to act as requested. This distinction rests on the well-known fact that administrative claims and appeals (reclamos y recursos administrativos), unlike straightforward petitions, require a procedure to verify the facts that will serve as the grounds for the final administrative act (acto final), as well as the adoption of the relevant evidentiary measures (medidas probatorias).

Furthermore, given its relevance to this application for amparo (amparo), it must be emphasized that the right guaranteed by Articles 27 and 30 of the Constitución Política is not contingent upon the applicant stating an opinion or being required to provide a statement regarding the information requested. A citizen has the right to request information, and the public entity is obligated to provide it. If the information is not contained in its records, it must explain that fact to the applicant. A request for information must also be distinguished from a complaint (denuncia). When the latter is filed, the public entity is obligated to process it, investigate whatever is necessary, and rule on the matter raised. When the matter concerns a request for information, the public entity is obligated to provide it or explain that it does not possess the information.

V.Specific case. Based on the reports submitted under oath, subject to the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction, and on the documentation submitted, it is established that, on 4 de agosto del 2023, the appellant requested information from the Concejo Municipal concerning the Los Pinos sanitary landfill (relleno sanitario), located in Navarro de Dulce Nombre01 de Cartago. He specifically submitted the following 16 questions:

“1. Is this Concejo Municipal aware of the current condition of the Los Pinos sanitary landfill located in Navarro de Dulce Nombre01 de Cartago? 2. Are you aware whether SETENA has granted environmental viability (viabilidad ambiental) for the new site that the company is operating? 3. Does the operating health permit (permiso sanitario de funcionamiento) issued in 2018 by the Ministerio de Salud (MINSA) de Cartago to the operating company contracted by this Municipalidad apply to the area belonging to the operating company, or only to the land occupied by the former dump? 4. Is this Concejo Municipal aware of the useful life of the former dump? 5. Does the operating company receive waste from places located far from Cartago, and who authorized it? 6. Are you aware whether the operating company is depositing waste on the property belonging to that company, located next to the former dump, and whether it has the approval of SETENA, the Municipalidad de Cartago, and the Ministerio de Salud Cartago? 7.

If so, under what criteria were those permits granted? 8. Does this Municipalidad have LEACHATE AND GROUNDWATER CHARACTERIZATION STUDIES (ESTUDIOS DE CARACTERIZACION DE LIXIVIADOS Y LAS AGUAS SUBTERRANEAS) FOR THE LOS PINOS DUMP (NAVARRO)? If so, I respectfully request that I be provided with copies of those from the last 3 months. 9. Are there design plans for the post-closure works (obras de post-cierre) to be undertaken once the technical closure works (obras de cierre técnico) for the former dump have been completed? 10. Are you aware of the DAILY TONNAGE entering that sanitary landfill? 11. I would also like to request the tonnage intake report for the last three months of 2023. 12. Has this municipality approved any design change to the land belonging to this Municipalidad under the contract between this Municipalidad and the company operating the site? 13. Has the operating company submitted any preliminary plan or timetable for the final closure of the Los Pinos sanitary landfill? 14.

Are you aware whether the company managing the Los Pinos landfill has submitted any post-closure plan for that location? 15. If there has been any design change to the Los Pinos sanitary landfill, when was it accepted by this Municipalidad and which officials approved it? 16. A copy of report CNEUIAR-INF-0519-2019 of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE), which is contained in the case file (expediente) for the Los Pinos sanitary landfill.” It was also established that, on 16 de agosto del 2023, the Council notified the appellant that, at the Ordinary Session held on 8 de agosto del 2023, Minutes Nº 260-2023, Article Nº19, it had resolved to refer the matter to the Administration. Subsequently, on 28 de setiembre del 2023, the Council notified the appellant of the decision adopted at the Ordinary Session held on 19 de setiembre del 2023, Minutes Nº 271-2023, Article Nº9, under which it requested the following from the appellant and a representative of WPP Continental, the company operating the sanitary landfill: “… that they provide, in writing and in a detailed and specific manner, their respective statements: Mr. [Nombre01 002] regarding the statements made by Ms. [Nombre01 006], and said woman as to whether she wishes to respond specifically to each inquiry that Mr. [Nombre01 002] has submitted to this Council, considering her capacity as legal representative of WPP Continental Los Pinos S.A.” It follows from the foregoing, first, that the appellant submitted a request for information rather than a complaint and, second, that the Municipalidad has not provided the appellant with the requested information.

If the Council does not possess the information, it is authorized to obtain it, provided that it supplies the requested information within the period established in Article 32 of the Ley de la Jurisdicción Constitucional (ten business days). Furthermore, if the request for information leads the Municipalidad to conclude that it has grounds to conduct an investigation, it is authorized to do so, but that is a separate matter from its obligation to answer the questions submitted.

Both the President of the Council and the Mayor contend that the Municipalidad has not responded for reasons attributable to the appellant, because he has not commented on the statements made by the representative of the company responsible for the sanitary landfill. However, as explained above, the right of petition is not contingent upon the appellant having to provide an opinion, much less upon confronting him with the opinion expressed, in this case, by the company’s representative. Consequently, the municipal entity’s omission does violate the rights of the protected party (amparado).

In a separate argument, the Mayor contended that the resolution by which the Council referred the matter to the Administration was abrogated by the subsequent resolution requesting that the appellant comment on the statements made by the company’s representative. This Chamber is not called upon to rule on that issue, as it is not relevant to this application for amparo. It is an internal matter of the Municipalidad. This application for amparo is granted against the Municipalidad as the single entity that it is. The order is issued against the President because the request was addressed to the Council. In sum, for the reasons stated, the application for amparo must be granted.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The appellant is hereby advised that, if any paper document was submitted, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, such items must be retrieved from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session number 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session number 43-12 held on 3 de mayo del 2012, Article LXXXI.

THEREFORE:

The appeal is granted. Consequently, Jonathan Arce Moya, Municipal President of Cartago, or whoever holds that office, is ordered to take the necessary steps so that, within five business days from notification of this judgment, the petitioner is provided with the information requested on 4 de agosto del 2023, safeguarding any sensitive or confidential data for such purposes, if any, in accordance with the Law on the Protection of Individuals with Regard to the Processing of Their Personal Data (Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales) (ley número 8968). Notice is hereby given that, pursuant to Article 71 of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional), anyone who receives an order issued in an amparo proceeding (recurso de amparo) that must be complied with or enforced, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. Municipalidad de Cartago is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed in the judgment-enforcement proceedings before the administrative litigation court.

Documento PJEDITOR SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del doce de enero de dos mil veinticuatro .

Recurso de amparo interpuesto por [Nombre01 001], cédula de identidad número [CED01], contra la Municipalidad de Cartago.

RESULTANDO:

  1. 1Por escrito agregado a este expediente el 11 de octubre del 2023, el recurrente alegó, en resumen, que, el 4 de agosto de 2023, planteó ante el Concejo Municipal de Cartago una solicitud de información referente al relleno sanitario Los Pinos (ubicado en Navarro de Dulce Nombre01 de Cartago). Sin embargo, no se le ha brindado la información solicitada.
  2. 2Por resolución de las 9:31 horas del 8 de noviembre del 2023, se le dio curso al proceso.
  3. 3Por escrito agregado a este expediente el 15 de noviembre del 2023, Jonathan Arce Moya, Presidente Municipal de Cartago, rindió el informe. Indicó lo siguiente:

“Tal y como consta de la documentación certificada adjunta, la comuna está dando el debido trámite a la solicitud de información que denuncia como omisa el recurrente en esta vía y, todo lo contrario, es por causa imputable a él, que este asunto no se ha finalizado, sea porque no atendió la audiencia conferida por el Concejo según se aprecia en el artículo 9 acta 271-2023 del 19 de setiembre del 2023, se dispuso acoger recomendación técnica y en consecuencia se acordó:

“…otorgar un plazo de 10 días hábiles a ambas partes, para que, por escrito y de manera detallada y puntual, se manifiesten, don [Nombre01 002], en acerca de las manifestaciones de doña [Nombre01 006] …” Corolario de lo anterior, no existe derecho constitucional alguno que haya sido conculcado al recurrente de autos, por lo que se solicita declarar sin lugar esta acción”.

  1. 4Por escrito agregado a este expediente el 18 de noviembre del 2023, el recurrente replicó el informe. Indicó que, en lugar de brindarle la información, el Concejo pretende que él se presente. Alega que la administración municipal no ha informado al Concejo sobre los daños ambientales del relleno sanitario Los Pinos. A su juicio, el Concejo, en lugar de brindar la información presenta excusas. Por otra parte, manifiesta que el mismo día que el Concejo conoció su solicitud, la empresa WPP Continental, que administra el relleno sanitario, presenta una nota en la que debate lo que él solicitó. Recalca que no ha recibido la información, pese a que, el 16 de octubre del 2023, insistió que se le brindara.
  2. 5Por resolución de las 13:33 horas del 21 de noviembre del 2023, se amplió este amparo contra el Alcalde Municipal de Cartago,
  3. 6Por escrito agregado a este expediente el 19 de diciembre del 2023, Mario Redondo Poveda, Alcalde Municipal de Cartago, rindió el informe. Indicó lo siguiente:

“El suscrito Alcalde Municipal de Cartago, conforme lo demuestro con certificación adjunta, en relación con el auto de las 13:33 horas del 21 de noviembre del 2023, me refiero al presente amparo, lo que hago de la siguiente forma:

Comparto en todos sus extremos, hago mío y reitero, lo que ya el señor Presidente informó, y demostró, a esta estimable Sala con ocasión del amparo de marras:

“…Tal y como consta de la documentación certificada adjunta, la comuna está dando el debido trámite a la solicitud de información que denuncia como omisa el recurrente en esta vía y, todo lo contrario, es por causa imputable a él, que este asunto no se ha finalizado, sea porque no atendió la audiencia conferida por el Concejo según se aprecia en el artículo 9 acta 271-2023 del 19 de setiembre del 2023, se dispuso acoger recomendación técnica y en consecuencia se acordó:

“…otorgar un plazo de 10 días hábiles a ambas partes, para que, por escrito y de manera detallada y puntual, se manifiesten, don [Nombre01 002], en acerca de las manifestaciones de doña [Nombre01 006]…” Y es que el recurrente, de manera inadecuada y con el fin de llamar a engaños a este Tribunal, obvia puntualizar el hecho de Perogrullo que el acuerdo de su interés, sea el contenido en el artículo N°19 del Acta N°260 de la sesión del 8 de agosto del 2023, es anterior al que fundamenta la respuesta que hace el señor Presidente del Concejo a la Sala, sea el contenido en el artículo 9 acta 271-2023 del 19 de setiembre del 2023, por lo que fue abrogado por éste, con lo que prevale el último acuerdo recién referido el que, como consta en la documentación aportada con el informe del señor Presidente, lo que dispuso fue NO ya requerir un informe a la Administración sino que:

“…otorgar un plazo de 10 días hábiles a ambas partes, para que, por escrito y de manera detallada y puntual, se manifiesten, don [Nombre01 002], en acerca de las manifestaciones de doña [Nombre01 006]…” Se insiste en que, al día de hoy, el recurrente NO ha atendido la audiencia que le otorgó el Concejo por unanimidad, lo que impide resolver el escrito de su interés en definitiva por que, como se aprecia en el citado acuerdo contenido en el artículo 9 acta 271-2023 del 19 de setiembre del 2023, en esa sesión y acuerdo se conoció tanto su escrito inicial como un escrito de un tercero -doña [Nombre01 004] Representante Legal WPP Continental Los Pinos S.A-, lo que obligó al Concejo a que ambas partes se manifestaran al respecto:

“ARTÍCULO 9. -INFORME AL ARTÍCULO 19 ACTA 206-2023, SOLICITUD AL CONCEJO MUNICIPAL DE INFORMACIÓN RELACIONAD AL RELLENO SANITARIO LOS PINOS, PRESENTADA POR EL SEÑOR [Nombre01 001] Y AL ARTÍCULO 34 ACTA 262- 2023, OFICIO RELACIONADO A LA SOLICITUD DE INFORMACIÓN DEL SEÑOR [Nombre01 001], PRESENTADO POR LA SEÑORA [Nombre01 005] REPRESENTANTE LEGAL WPP CONTINENTAL LOS PINOS S.A.” Es más, de la simple lectura de ese acuerdo último, se observa que el escrito cuya omisión de respuesta acusa el recurrente, hasta fue abordado y conocido en dicha sesión por la parte técnica de la Administración:

Se conoce oficio AM-lNF-281-2023 de fecha 04 de setiembre del 2023, suscrito por el Lic. Mario Redondo Poveda Alcalde Municipal, por el cual remite el oficio AL-OF-4012023/AOM-OF-124-2023 de fecha 25 de agosto del 2023, suscrito por el MSC. Wilberth Quesada Garita Director Jurídico a.i. y el Ing. Jorge Araya Serrano Encargado área de operaciones, y que dice: .En relación con el asunto que se cita en referencia, informamos:

Ese oficio técnico fue aprobado por el Concejo según en dicho acuerdo:

El presidente Arce Moya propone dispensar de trámite de comisión, somete a discusión, suficientemente discutido, somete a votación, dando como resultado siete votos afirmativos de los regidores Nombre02, Nombre03, Brenes Figueroa, Guzmán Castillo, Torres Céspedes, Halabí Fauaz y Arce Moya, votan negativo Víquez Sánchez y Madriz Jiménez; se dispensa de trámite de comisión. El presidente propone acoger el informe AL-OF-401-2023fAOM-OF-124-2023, somete a discusión, suficientemente discutido. somete a votación. se acuerda por unanimidad de nueve votos afirmativos de los regidores Nombre02, Nombre03, Víquez Sánchez, Madriz Jiménez, Brenes Figueroa, Guzmán Castillo, Torres Céspedes, Halabí Fauaz y Arce Moya, acoger el informe AL-OF-401-2023/AOM-OF-124-2023, por lo tanto se otorga un plazo de 10 días hábiles a ambas partes, para que, por escrito y de manera detallada y puntual, se manifiesten, don [Nombre01 002], en acerca de las manifestaciones de doña [Nombre01 006] y, dicha señora, exprese si tiene interés en referirse de manera puntual a cada consulta que ha hecho don [Nombre01 002] a este Concejo, considerando su carácter de representante legal de WPP Continental Los Pinos S.A. El presidente Arce Moya solicita la firmeza, somete a discusión. suficientemente discutido. somete a votación, se acuerda por unanimidad de nueve votos afirmativos de los regidores Nombre02, Nombre03, Víquez Sánchez, Madriz Jiménez, Brenes Figueroa, Guzmán Castillo, Torres Céspedes Halabí Fauaz y Arce Moya, aprobar la firmeza.

Notifíquese este acuerdo con acuse y fecha de recibo al señor [Nombre01 001] al correo electrónico [...], a la señora [Nombre 004] Representante Legal WPP Continental Los Pinos SA. al correo electrónico [...] y al Lic. Mario Redondo Poveda Alcalde Municipal. Acuerdo definitivamente a probado.

Luego, se insiste, no solo ya fue respondido el oficio que interesa a la parte recurrente, sino que, además, es por su incuria que NO se ha resuelto de manera definitiva.

Como prueba de todo lo anterior, remito a la que fue presentada por el señor Presidente del Concejo”.

  1. 7Por escrito agregado a este expediente el 26 de diciembre del 2023, el recurrente replicó los informes y reiteró su solicitud de acoger este amparo.
  2. 8En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I. OBJETO

El recurrente alegó que, el 4 de agosto de 2023, planteó ante el Concejo Municipal de Cartago una solicitud de información referente al relleno sanitario Los Pinos (ubicado en Navarro de Dulce Nombre01 de Cartago). Sin embargo, no se le ha brindado la información solicitada.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • 1)El 4 de agosto del 2023, el recurrente solicitó al Concejo Municipal de Cartago la siguiente información:

“1. ¿Conoce este Concejo Municipal el estado actual del relleno sanitario Los Pinos ubicado en Navarro de Dulce Nombre01 de Cartago? 2. ¿Conocen ustedes si la SETENA le ha otorgado la viabilidad ambiental del nuevo sitio que la empresa está operando? 3. ¿El permiso sanitario de funcionamiento entregado por el Ministerio de Salud (MINSA) de Cartago, le fue otorgado a la empresa operadora contratada por esta Municipalidad, en el año 2018, está rigiendo para el área que pertenece a la empresa operadora, o solo para el terreno del antiguo vertedero? 4. ¿Conoce este Concejo Municipal la vida útil del antiguo vertedero? 5. ¿La empresa operadora recibe desechos de lugares situados a larga distancia de Cartago, quien los ha autorizado? 6. ¿Conocen ustedes si la empresa operadora está depositando desechos en la propiedad que pertenece a dicha empresa que se ubica a un costado del antiguo vertedero, y si tienen el aval de la SETENA, la Municipalidad de Cartago y el Ministerio de Salud Cartago? 7.

De ser así ¿Bajo qué criterios se les otorgo dichos permisos? 8. ¿Cuenta esta Municipalidad Con ESTUDIOS DE CARACTERIZACION DE LIXIVIADOS Y LAS AGUAS SUBTERRANEAS DEL VERTEDERO DE LOS PINOS, (NAVARRO)?.De ser así solicito con el debido respeto se me entregue copia de ellos, de los últimos 3 meses? 9. ¿Existen planos de diseño para las obras de post-cierre, una vez concluidas las obras de cierre técnico del antiguo vertedero? 10. ¿Conocen ustedes el ingreso de las TONELADAS DIARIAS que ingresan a dicho relleno sanitario? 11. ¿Aprovecho para solicitarles el informe de ingreso de toneladas de los últimos tres meses del año 2023? 12. ¿Ha avalado este municipio algún cambio de diseño en el terreno que pertenece a esta Municipalidad dentro del contrato, entre esta Municipalidad y la empresa operadora del sitio? 13. ¿Ha presentado la empresa operadora algún anteproyecto o cronograma de cierre final del relleno sanitario de Los Pinos? 14.

¿Conocen ustedes si la empresa administradora del relleno Los Pinos ha presentado algún plan de post-cierre de dicho lugar? 15. ¿Si ha habido, algún cambio de diseño del relleno sanitario los Pinos, cuando fue aceptado por esta Municipalidad y cuales funcionarios lo avalaron? 16. Copia del informe CNEUIAR-INF-0519-2019 de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE), el cual se encuentra dentro del expediente del relleno sanitario de Los Pinos” (copia aportada).

  • 2)El 16 de agosto del 2023, el Concejo comunicó al recurrente lo acordado, en relación con su solicitud, en Sesión Ordinaria celebrada el día 8 de agosto del 2023, Acta Nº 260-2023, Artículo Nº19, que indica los siguiente:

“El presidente Arce Moya propone trasladar a la Administración, somete a discusión el dictamen, suficientemente discutido, somete a votación, se acuerda por unanimidad de nueve votos afirmativos de los regidores Nombre02, Nombre03, Víquez Sánchez, Madriz Jiménez, Brenes Figueroa, Guzmán Castillo, Torres Céspedes, Halabí Fauaz y Arce Moya, trasladar a la Administración” (copia aportada).

  • 3)El 28 de setiembre del 2023, el Concejo comunicó al recurrente lo acordado en Sesión Ordinaria celebrada el día 19 de setiembre del 2023, Acta Nº 271-2023, Artículo Nº9, que indica lo siguiente:

“… se acuerda por unanimidad de nueve votos afirmativos de los regidores Nombre02, Nombre03, Víquez Sánchez, Madriz Jiménez, Brenes Figueroa, Guzmán Castillo, Torres Céspedes, Halabí Fauaz y Arce Moya, acoger el informe AL-OF-401-2023/AOM-OF-124-2023, por lo tanto se otorga un plazo de 10 días hábiles a ambas partes, para que, por escrito y de manera detallada y puntual, se manifiesten, don [Nombre01 002], en acerca de las manifestaciones de doña [Nombre01 006] y, dicha señora, exprese si tiene interés en referirse de manera puntual a cada consulta que ha hecho don [Nombre01 002] a este Concejo, considerando su carácter de representante legal de WPP Continental Los Pinos S.A.” (documentación aportada).

III. HECHOS NO PROBADOS

De importancia para resolver este proceso, se tiene por no demostrado el siguiente: Único.- Que el Concejo hubiera brindado la información solicitada.

IV.Derecho de petición y acceso a la información pública. En lo que atañe a la violación del derecho petición, debe indicarse que el artículo 27 de la Constitución Política consagra el derecho subjetivo público que tiene toda persona, tanto física como jurídica, de acudir a cualquier órgano o entidad pública a peticionar sobre un asunto de su interés, el cual deberá ser contestado por la Administración en forma oportuna, razonable, congruente, eficaz y en un plazo breve. El ejercicio del derecho de petición puede ser tanto individual como colectivo y, además, no requiere de intereses legítimos o subjetivos, dado que el mismo se deriva de las obligaciones propias que tiene el Estado frente al administrado. Dentro de este orden de ideas, la jurisprudencia de esta Sala Constitucional ha establecido con claridad que, mediando una solicitud de información por parte de un administrado ante una dependencia pública, ésta debe respetar en todo momento los plazos establecidos para dar contestación, todo de conformidad con el numeral 27 de la Constitución Política, en relación con el artículo 32 de la Ley de la Jurisdicción Constitucional. Por otro lado, el artículo 30 de la Constitución Política dispone lo siguiente:

«ARTÍCULO 30.- Se garantiza el libre acceso a los departamentos administrativos con propósitos de información sobre asuntos de interés público.

Quedan a salvo los secretos de Estado».

Por otra parte, esta Sala ha puntualizado que este derecho hace referencia a aquellos supuestos en que se formulan peticiones puras y simples de información. Distinto es el caso en que el interesado solicita a la Administración que rectifique lo que considera que es un error o, en general, que la Administración actúe conforme se le solicita. Esta distinción descansa en el hecho, bien conocido, de que los reclamos y recursos administrativos, a diferencia de las peticiones puras, requieren un procedimiento para verificar los hechos que han de servir de motivo al acto final, así como adoptar las medidas probatorias pertinentes.

Por otra parte, es necesario hacer énfasis, por la relevancia para este amparo, que el derecho garantizado en los artículos 27 y 30 de la Constitución Política no está supeditado a que el solicitante exponga su opinión o deba manifestarse en relación con la información que solicita. El ciudadano tiene derecho a solicitar información y la entidad pública está obligada a brindar la información. Si esta no consta en sus archivos, así tendrá que explicarlo al solicitante. Debe distinguirse también entre una solicitud de información y una denuncia. Cuando se presenta esta última, el ente público está obligado a darle trámite, investigar lo que sea necesario y pronunciarse sobre lo planteado. Cuando se trata de una solicitud de información, el ente público está obligado a darla o a explicar que no tiene en su poder tal información.

V.Caso concreto. De conformidad con los informes bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción, y la documentación aportada, se comprueba que, en efecto, el 4 de agosto del 2023, el recurrente solicitó al Concejo Municipal información relativa al relleno sanitario Los Pinos ubicado en Navarro de Dulce Nombre01 de Cartago. Planteó específicamente 16 preguntas, que son las siguientes:

“1. ¿Conoce este Concejo Municipal el estado actual del relleno sanitario Los Pinos ubicado en Navarro de Dulce Nombre01 de Cartago? 2. ¿Conocen ustedes si la SETENA le ha otorgado la viabilidad ambiental del nuevo sitio que la empresa está operando? 3. ¿El permiso sanitario de funcionamiento entregado por el Ministerio de Salud (MINSA) de Cartago, le fue otorgado a la empresa operadora contratada por esta Municipalidad, en el año 2018, está rigiendo para el área que pertenece a la empresa operadora, o solo para el terreno del antiguo vertedero? 4. ¿Conoce este Concejo Municipal la vida útil del antiguo vertedero? 5. ¿La empresa operadora recibe desechos de lugares situados a larga distancia de Cartago, quien los ha autorizado? 6. ¿Conocen ustedes si la empresa operadora está depositando desechos en la propiedad que pertenece a dicha empresa que se ubica a un costado del antiguo vertedero, y si tienen el aval de la SETENA, la Municipalidad de Cartago y el Ministerio de Salud Cartago? 7.

De ser así ¿Bajo qué criterios se les otorgo dichos permisos? 8. ¿Cuenta esta Municipalidad Con ESTUDIOS DE CARACTERIZACION DE LIXIVIADOS Y LAS AGUAS SUBTERRANEAS DEL VERTEDERO DE LOS PINOS, (NAVARRO)?. De ser así solicito con el debido respeto se me entregue copia de ellos, de los últimos 3 meses? 9. ¿Existen planos de diseño para las obras de post-cierre, una vez concluidas las obras de cierre técnico del antiguo vertedero? 10. ¿Conocen ustedes el ingreso de las TONELADAS DIARIAS que ingresan a dicho relleno sanitario? 11. ¿Aprovecho para solicitarles el informe de ingreso de toneladas de los últimos tres meses del año 2023? 12. ¿Ha avalado este municipio algún cambio de diseño en el terreno que pertenece a esta Municipalidad dentro del contrato, entre esta Municipalidad y la empresa operadora del sitio? 13. ¿Ha presentado la empresa operadora algún anteproyecto o cronograma de cierre final del relleno sanitario de Los Pinos? 14.

¿Conocen ustedes si la empresa administradora del relleno Los Pinos ha presentado algún plan de post-cierre de dicho lugar? 15. ¿Si ha habido, algún cambio de diseño del relleno sanitario los Pinos, cuando fue aceptado por esta Municipalidad y cuales funcionarios lo avalaron? 16. Copia del informe CNEUIAR-INF-0519-2019 de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE), el cual se encuentra dentro del expediente del relleno sanitario de Los Pinos”.

Se demostró, además, que, el 16 de agosto del 2023, el Concejo comunicó al recurrente que, en Sesión Ordinaria celebrada el día 8 de agosto del 2023, Acta Nº 260-2023, Artículo Nº19, acordó trasladar la gestión a la administración. Posteriormente, el 28 de setiembre del 2023, el Concejo comunicó al recurrente lo acordado en Sesión Ordinaria celebrada el día 19 de setiembre del 2023, Acta Nº 271-2023, Artículo Nº9, según el cual solicita a recurrente y a un representante de la empresa WPP Continental, operadora del relleno sanitario lo siguiente: “… que, por escrito y de manera detallada y puntual, se manifiesten, don [Nombre01 002], en acerca de las manifestaciones de doña [Nombre01 006] y, dicha señora, exprese si tiene interés en referirse de manera puntual a cada consulta que ha hecho don [Nombre01 002] a este Concejo, considerando su carácter de representante legal de WPP Continental Los Pinos S.A.” De lo expuesto se concluye, en primer término, que el recurrente planteó una petición de información y no una denuncia y, por otra parte, que la Municipalidad no ha brindado al recurrente la información solicitada.

Si el Concejo no tiene en su poder la información, está facultado para recabarla, siempre y cuando brinde la información solicitada en el plazo establecido en el artículo 32 de la Ley de la Jurisdicción Constitucional (de diez días hábiles). Por otra parte, si a raíz de la solicitud de información la Municipalidad considera que tiene motivos para realizar una investigación, está facultada para hacerlo, pero esto es una cuestión distinta a la obligación que tiene de responder a las preguntas planteadas.

Tanto el Presidente del Concejo como el Alcalde alegan que la Municipalidad no ha dado respuesta por causas imputables a él, pues no se ha manifestado sobre lo dicho por la representante de la empresa a cargo del relleno sanitario. Sin embargo, como se aclaró anteriormente, el derecho de petición no está supeditado a que el recurrente tenga que dar una opinión ni mucho menos enfrentarlo a lo que opine, en este caso, la representante de la empresa. El consecuencia, la omisión del ente municipal sí lesiona los derechos del amparado.

En otro orden de ideas, el Alcalde alegó que el acuerdo por medio del cual el Concejo trasladó la gestión a la Administración fue abrogado por el que, posteriormente, solicitó al recurrente manifestarse sobre lo dicho por la representante de la empresa. Sobre este punto no le corresponde a esta Sala pronunciarse, pues no resulta relevante para este amparo. Se trata de una cuestión interna de la Municipalidad. Este amparo se declara con lugar contra la Municipalidad como un único ente que es. La orden se dicta contra el Presidente pues la solicitud está dirigida al Concejo. En suma, de conformidad con las razones expuestas, el amparo debe declararse con lugar.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara con lugar el recurso. En consecuencia, se le ordena a Jonathan Arce Moya, Presidente Municipal de Cartago, o a quien ocupe ese cargo, que realice las gestiones necesarias para que, en el plazo de cinco días hábiles, contados a partir de la notificación de esta sentencia, se brinde al recurrente la información solicitada el 4 de agosto del 2023, salvaguardando para tales efectos los datos sensibles o confidenciales, en caso de haberlos, de conformidad con la Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales (ley número 8968). Se advierte que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Cartago al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
