Document Review Decision No. 2024000322 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine fifteen a.m. on January tenth, two thousand twenty-four.

Action of unconstitutionality (acción de inconstitucionalidad) filed by Nombre01, in his capacity as president of the Chamber of Industry, Commerce and Services in the canton of La Unión, legal entity identification number CED01, against the Ministry of Health and the current sound-measurement procedure (procedimiento de medición de sonidos).

Findings:

  1. 1In a brief submitted to this Chamber on November 29, 2023, the petitioner filed an action of unconstitutionality against the Ministry of Health and the current sound-measurement procedure. He states that the Ministry of Health, exercising the powers conferred upon it by Articles 140, subsections 3) and 18), and 146 of the Political Constitution; 2, 4, 7, 37, 38, 263, 293, 325, 337, 338, 339, 340, 341, 342, 347, 348, 349, 355, 357, 363, 364, and related provisions of Law No. 5395 of October 30, 1973, "Ley General de Salud"; 6 of Law No. 541 2 of November 8, 1973, "Ley Orgánica del Ministerio de Salud"; and 25, subsection 1), and 28, subsection b), of Law No. 6227 of May 2, 1978, "Ley General de Administración Pública," created the noise-measurement procedure (procedimiento para la medición de ruido), Decree No. 32692. For the purpose of organizing and standardizing the noise-measurement procedure, it establishes that sound measurement (medición sónica) constitutes the appropriate technical means and conclusive evidence (prueba fehaciente) for verifying the existence of noise that may affect the health of the population, and therefore requires the use of methods that ensure that the values obtained are reliable and permit correct and sound decisions in this area.It is necessary and appropriate to establish a procedure for measuring noise, in order to establish procedures consistent with the standards prescribed for conducting measurement tests. He asserts that a sound level meter (sonómetro)—an instrument used to measure sound levels—is currently used to conduct these measurements. At present, the Ministry of Health uses a CIRRUS SOUND LEVEL METER, model CR:171B (serial number G301504), with Cirrus Model MK224 microphone (serial number 2128879D) and Cirrus Model MV200F preamplifier (serial number 10249F). He alleges that the current noise-measurement procedure completely disregards and violates Decree No. 32692. They fail to identify and locate the affected person and do not coordinate the time or place where the sound measurements will be conducted; furthermore, the measurements are conducted by only one official of that institution, in disregard of section 4, subsections a and c, of Decree No. 32692.Before conducting any type of measurement, they fail to record the full name and identity card or passport number of the persons present while the measurements are taken. They also fail to record the start and end dates and times of the measurements, as required by Article 6, subsection A. The procedure does not position the sound level meter at an approximate height of 1.5 m above ground level, nor does it maintain the angle between the sound level meter and an inclined plane parallel to the ground between 30 and 60 degrees, as required by Article 6, subsection c, of Decree No. 32692. They fail to ensure a minimum approximate unobstructed distance of 0.50 m from the official’s body, as required by Article 6, subsection d, of Decree 32692. They fail to conduct the 15 measurements and record each measurement result as prescribed by Article 6, subsection 1, and instead conduct only one continuous five-minute measurement.They fail to take the measurements at 15-second intervals, as required by Article 6, subsection h. They fail to discard measurements that include occasional noise (Article 6, subsection j). They fail to calculate sound pressure levels (niveles de presión sonora) (Article 7). They fail to record the weighting and attenuation scale (escala de ponderación y atenuación) used (Article 8, subsection l). They fail to state the type of noise (tipo de ruido) involved (Article 8, subsection j). They fail to record the weather conditions (condiciones meteorológicas) (Article 8, subsection k). The only action taken by the Ministry of Health is to conduct one continuous five-minute measurement at whatever location it deems appropriate, without complying in any respect with the current procedure cited above. He states that, in official letter MS-DPRSA-USA-2303-2023 dated November 8, 2023, Engineer Eugenio Androvetto Villalobos, Director of the Directorate of Radiological Protection and Environmental Health, issued a technical opinion and, in point 3 thereof, stated that the Ministry of Health currently has sound level meters that do not require that procedure.He therefore brings this action of unconstitutionality because it is expressly acknowledged that the current noise-measurement procedure is not being used. He cites Article 73 of the Ley de la Jurisdicción Constitucional, stating that: “An action of unconstitutionality shall lie: a) Against laws and other provisions of general application, including those arising from acts of private parties, that infringe, by action or omission, any constitutional rule or principle. b) Against individual acts of public authorities when, by action or omission, they infringe any constitutional rule or principle, if such acts are not subject to habeas corpus or amparo remedies” (he states that he attaches the official letter). He states that it is known that the CIRRUS sound level meter, model CR:171B (serial number G301504), with Cirrus model MK224 microphone (serial number 2128879D) and Cirrus Model Mv200F preamplifier (serial number 10249F), is a device that does not comply with the regulations currently in force, because the letter literally states the following: “said sound level meter DOES NOT COMPLY with the current noise-measurement procedure under Decree N° 32692; therefore, in order to put these sound level meters into use, the Ministry of Health should have repealed Decree N° 32692 and created a new noise-measurement procedure.CONCLUSION The methodology currently being used by the Ministry of Health for noise measurement is an UNCONSTITUTIONAL procedure because it is not using the current procedure, which clearly means that it is manipulating a procedure that IS NOT REGULATED, in total violation of the procedure established by Decree N° 32692.” As his legal argument, he cites: “POLITICAL CONSTITUTION ART. 140 The following are duties and powers jointly vested in the President and the respective Government Minister: SUBSECTION 3 To approve and promulgate laws, regulate and implement them, and ensure their faithful compliance SUBSECTION 18 To issue such regulations as may be appropriate for the internal operation of their offices, and to issue any other regulations and ordinances necessary for the prompt implementation of the laws, ARTICLE 146.- Decrees, agreements, decisions, and orders of the Executive Branch require, for their validity, the signatures of the President of the Republic and the Minister of the respective portfolio and, in addition, in the cases established by this Constitution, the approval of the Council of Government. • POLITICAL CONSTITUTION ART. 11 - Ley General de Salud Articles 2°, 4°, 7°, 37, 38, 263, 293, 325, 337, 338, 339, 340, 341, 342, 347, 348, 349, 355, 357, 363, 364, and related provisions of Law N° 5395 of October 30, 1973 Ley Orgánica del Ministerio de Salud Article 6° of Law N° 5412 of November 8, 1973 • Ley General de Administración Pública Articles 11, 25, subsection 1), and 28, subsection b), of Law No. 6227 of May 2, 1978 • Ley de Jurisdicción Constitucional Articles 2 and 73 • DECREE N° 32692 Articles 4, 6, and 8.” He requests that the action of unconstitutionality be declared admissible and granted on the merits because of the inaction, omissions, and abstentions of the Ministry of Health in failing to apply a procedure currently in force (Decree No. 32692).
  2. 2Article 9 of the Ley de la Jurisdicción Constitucional empowers the Chamber, at any time, including upon initial filing, to summarily dismiss or dismiss on the merits any application submitted for its consideration that is manifestly inadmissible, when it determines that there are sufficient grounds for dismissal, or when the application is merely a reiteration or reproduction of a previously rejected identical or similar application.

Justice Castillo Víquez drafts the opinion; and,

Considering:

I.Formal requirements for the admissibility (admisibilidad) of the action. An action of unconstitutionality is a proceeding subject to certain formalities that must be satisfied for the Chamber to validly consider the merits of the challenge. In this regard, Article 75 of the Ley de la Jurisdicción Constitucional establishes the admissibility requirements (presupuestos de admisibilidad) for an action of unconstitutionality. First, there must be a prior matter pending resolution, either in judicial proceedings or in proceedings to exhaust administrative remedies (agotar la vía administrativa), in which the unconstitutionality has been invoked as a reasonable means of protecting the right or interest alleged to have been infringed. In the second and third paragraphs, the law exceptionally establishes circumstances in which no prior matter is required, where, because of the nature of the matter, there is no individual and direct injury, where the defense of diffuse or collective interests (intereses difusos o colectivos) is involved, or where the action is filed directly by the Comptroller General of the Republic, the Attorney General of the Republic, the Chief Public Prosecutor of the Republic, or the Ombudsman.

Other formalities must also be met, namely, explicit identification of the challenged provisions, supported by adequate grounds and specific citation of the constitutional rules and principles alleged to have been infringed; attorney authentication of the brief filing the action; proof of the conditions conferring standing (legitimación), including powers of attorney and certifications; and a verbatim certified copy of the brief in which the unconstitutionality of the provisions was invoked in the underlying matter. Failure by the petitioner to satisfy any of these requirements results in the action being declared inadmissible.

II.Failure to satisfy the admissibility requirements in this action of unconstitutionality. Upon review of the brief instituting this proceeding, the Court concludes that it lacks essential requirements for bringing the action and must therefore be summarily dismissed. First, the petitioner fails to explain under which circumstance set forth in Article 75 of the Ley de la Jurisdicción Constitucional he claims standing. Even if standing were recognized on the basis of defending corporate interests, because the petitioner represents the Chamber of Industry, Commerce and Services of the canton of La Unión, this Court notes from the legal-entity certification submitted by the applicant himself that the purpose of that association is as follows: “TO PROMOTE THE DEVELOPMENT OF INDUSTRY, COMMERCE, AND SERVICES IN THE CANTON OF LA UNIÓN; TO CREATE A CHANNEL OF COMMUNICATION AND DIRECT ENGAGEMENT WITH POLITICAL ACTORS AND ADMINISTRATIVE AUTHORITIES IN DEFENSE OF THE BUSINESS SECTOR; AND TO CREATE A FORUM FOR DISCUSSION AND THE DEVELOPMENT OF PROPOSALS TO IMPROVE ENTREPRENEURIAL CONDITIONS.” In other words, its powers do not include the judicial representation of its members or the authority to bring proceedings challenging legal provisions. Consequently, it lacks standing to bring this action. In view of all the foregoing, the action must be summarily dismissed.

III.Dissenting opinion (voto salvado) of Justice Rueda Leal. I depart from the opinion of the majority of this Court and dissent in this matter because I consider the decision to summarily dismiss this action of unconstitutionality (acción de inconstitucionalidad) to be premature. It is unquestionable that an action of unconstitutionality is a proceeding “instituted for the purpose of guaranteeing the supremacy of the Political Constitution over rules or other provisions of a general nature and that, for that very reason, a set of formalities must be fulfilled so that the Chamber may validly consider the merits of the challenge,” as has been stated in the extensive case law of this Chamber. However, it is precisely the law itself that prescribes how the various formalities and any failure to comply with them must be addressed, as may be inferred from the text of Article 80 of the Constitutional Jurisdiction Act (Ley de la Jurisdicción Constitucional), which provides:

“Article 80.- If the formalities referred to in the two preceding articles have not been fulfilled, the President of the Chamber shall specify by ruling which requirements have been omitted and shall order that they be fulfilled within three days (…)” In this matter, among other requirements, adequate and sufficient grounds are lacking, as required by Article 78 of the Ley de la Jurisdicción Constitucional; therefore, the order to cure deficiencies (prevención) unquestionably applies, so that the petitioner may remedy the omission identified. Likewise, it is by no means unnecessary to state that—in my opinion—the interpretation of Articles 78 and 79, as well as Article 80 itself, of the Act governing this jurisdiction must be broad and favorable to those who come before this Chamber, so that access to constitutional justice is not unnecessarily restricted.

IV.Documentation submitted to the case file (expediente). The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computing, magnetic, optical, or telematic device or produced by new technologies, these must be retrieved from the court clerk’s office within a maximum period of 30 business days from the notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

Por tanto:

The action is summarily dismissed. Justice Rueda Leal dissents and orders that the notice to cure deficiencies provided for in Article 80 of the Ley de la Jurisdicción Constitucional be issued.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del diez de enero de dos mil veinticuatro .

Acción de inconstitucionalidad promovida por Nombre01, en su condición de presidente de la Cámara de Industria, Comercio y Servicios en el cantón de la Unión, cédula jurídica CED01, contra el Ministerio de Salud y el procedimiento actual de medición de sonidos.

Resultando:

  1. 1Por escrito remitido a esta Sala el 29 de noviembre de 2023, el accionante interpone acción de inconstitucionalidad contra el Ministerio de Salud y el procedimiento actual de medición de sonidos. Manifiesta que, el Ministerio de Salud, en uso de las facultades que le confieren los artículos 140, incisos 3) y 18) y 146 de la Constitución Política, 2, 4, 7, 37, 38, 263, 293, 325, 337, 338, 339, 340, 341, 342, 347, 348, 349, 355, 357, 363, 364 y concordantes de la Ley nro. 5395 del 30 de octubre de 1973, "Ley General de Salud", 6 de la Ley nro. 541 2 del 8 de noviembre de 1973, "Ley Orgánica del Ministerio de Salud", 25, inciso 1) y 28, inciso b) de la ley número 6227 del 2 de mayo de 1978, "Ley General de Administración Pública", creó el procedimiento para la medición de ruido, decreto nro. 32692. Con la finalidad de ordenar y estandarizar el procedimiento para la medición de ruidos, establece que la medición sónica constituye el medio técnico idóneo y la prueba fehaciente para comprobar la existencia de ruidos que pueden afectar la salud de la población por lo que se requiere emplear métodos que garanticen que los valores obtenidos sean confiables y permitan decisiones correctas y acertadas en la materia.Que se hace necesario y oportuno establecer un procedimiento para medir el ruido, con la finalidad de establecer los procedimientos de acuerdo con las normas establecidas para efectuar las pruebas de medición. Afirma que, actualmente, para realizar estas mediciones utilizan un sonómetro (instrumento usado para medir los niveles de sonido). En la actualidad, el Ministerio de Salud utiliza un SONOMETRO CIRRUS, modelo CR:171B (serie G301504), con micrófono Cirrus Modelo MK224 (serie 2128879D) Preamplificador Cirrus Modelo MV200F (serie 10249F). Aduce que, el actual procedimiento para la medición de ruidos, omite e incumple en forma total el decreto nro. 32692. Omiten identificar y ubicar la persona afectada, y no coordinan la hora ni lugar de la realización de las mediciones sónicas, además las mediciones las realiza solo un funcionario de esta institución, obviando el numeral 4 del decreto nro. 32692 incisos a y c. Antes de efectuar cualquier tipo de medición, omiten que debe determinarse el nombre completo y el número de cédula de identidad o pasaporte de las personas presentes durante la realización de las mediciones.Y, anotar fecha y hora de inicio y de finalización de las mediciones, artículo 6 inciso A. El procedimiento no utiliza el sonómetro a una altura aproximada de 1,5 m del nivel del suelo y el ángulo formado entre el sonómetro y un plano inclinado paralelo al suelo, que debe encontrarse entre los 30 a 60 grados, artículo 6 decreto nro. 32692 inciso c. Se omite resguardar el colocarse a una distancia libre mínima aproximada de 0.50 m del cuerpo del funcionario, según el artículo 6 del decreto 32692, inciso d. Omiten realizar las 15 mediciones y las anotaciones de cada resultado de medición dispuestas en el artículo 6 inciso 1, solo realizan una medición de cinco minutos continuos. Omiten hacer las mediciones con los intervalos de 15 segundos, según lo dispone el artículo 6, inciso h. Omiten descartar las mediciones que incluyen ruidos ocasionales (art.6, inciso j). Omiten el cálculo de niveles de presión sonora (art. 7).Omiten anotar la escala de ponderación y atenuación empleada (art 8, inciso l). Se omite indicar cuál es el tipo de ruido (artículo 8, inciso j). Se omiten anotar las condiciones meteorológicas (artículo 8, inciso k). Lo único que realiza el Ministerio de Salud es una medición de 5 minutos, de forma continua, en el lugar donde ellos lo estimen pertinente, no ajustándose en nada al procedimiento vigente citado anteriormente. Refiere que, en el oficio MS-DPRSA-USA-2303-2023 del 8 de noviembre de 2023, el ingeniero Eugenio Androvetto Villalobos, director de la dirección de Protección Radiológica y Salud Ambiental, emitió criterio técnico y, en su punto 3 dicta que, actualmente el Ministerio de Salud cuenta con sonómetros que no requieren dicho procedimiento, por lo que promueve esta acción de inconstitucionalidad, ya que se reconoce expresamente que no se está utilizando el procedimiento de medición de ruido vigente.Cita el artículo 73 de la Ley de la Jurisdicción Constitucional indicando que, “Cabrá la acción de inconstitucionalidad: a) Contra las leyes y otras disposiciones generales, incluso las originadas en actos de sujetos privados, que infrinjan, por acción u omisión, alguna norma o principio constitucional. b) Contra los actos subjetivos de las autoridades públicas, cuando infrinjan, por acción u omisión, alguna norma o principio constitucional, si no fueren susceptibles de los recursos de habeas corpus o de amparo” (manifiesta que adjunta el oficio). Refiere que, a sabiendas de que el sonómetro CIRRUS modelo CR:171B (serie G301504), con micrófono Cirrus modelo MK224 (serie 2128879D), preamplificador Cirrus Modelo Mv200F (serie 10249F), es un aparato que no se ajusta a la normativa vigente, pues indica literalmente lo siguiente: “dicho sonómetro NO CONCUERDA al actual procedimiento de medición de ruido decreto N° 32692, por ende, para poner estos sonómetros en practica el ministerio de salud debió derogar el decreto N° 32692 y crear un nuevo procedimiento para la medición de ruidos.CONCLUSION La metodología que actualmente esta utilizando el Ministerio de Salud, en cuanto a la medición de ruido, es un procedimiento INCONSTITUCIONAL, pues no está utilizando el procedimiento vigente, lo que es claro que esta manipulando un procedimiento que NO ESTA NORMADO, violando en forma total el procedimiento decreto N° 32692”. Como argumento legal cita: “CONSTITUCION POLITICA ART. 140 Son deberes y atribuciones que corresponden conjuntamente al Presidente y al respectivo Ministro de Gobierno: INCISO 3 Sancionar y promulgar las leyes, reglamentarlas, ejecutarlas y velar por su exacto cumplimiento INCISO 18 Darse el Reglamento que convenga para el régimen interior de sus despachos, y expedir los demás reglamentos y ordenanzas necesarios para la pronta ejecución de las leyes, ARTICULO 146.- Los decretos, acuerdos, resoluciones y órdenes del Poder Ejecutivo, requieren para su validez las firmas del Presidente de la República y del Ministro del ramo y, además, en los casos que esta Constitución establece la aprobación del Consejo de Gobierno. • CONSTITUCION POLITICA ART 11 - Ley General de Salud Artículos, 2°, 4°, 7°, 37, 38, 263, 293, 325, 337, 338, 339, 340, 341, 342, 347, 348, 349, 355, 357, 363, 364 y concordantes de la Ley N° 5395 del 30 de octubre de 1973 Ley Orgánica del Ministerio de Salud Artículo 6° de la Ley N° 5412 del 8 de noviembre de 1973 • Ley General de Administración Pública Artículos 11, 25, inciso 1) y 28, inciso b) de la ley número 6227 del 2 de mayo de 1978 • Ley de Jurisdicción Constitucional Artículos 2 y 73 • DECRETO N° 32692 artículos 4, 6 y 8”.Pide que se declare la admisibilidad y con lugar la acción de inconstitucionalidad, debido a la inercia, las omisiones y las abstenciones del ministerio de Salud, al no aplicar un procedimiento vigente (decreto nro. 32692).
  2. 2El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I.Sobre los presupuestos formales de admisibilidad de la acción. La acción de inconstitucionalidad es un proceso con determinadas formalidades, que deben ser satisfechas a los efectos de que la Sala pueda válidamente conocer el fondo de la impugnación. En ese sentido, el artículo 75 de la Ley de la Jurisdicción Constitucional, establece los presupuestos de admisibilidad de la acción de inconstitucionalidad. En primer término, se exige la existencia de un asunto previo pendiente de resolver, sea en vía judicial, o bien, en el procedimiento para agotar la vía administrativa, en que se haya invocado la inconstitucionalidad como medio razonable para amparar el derecho o interés que se considera lesionado. En el párrafo segundo y tercero, la ley establece de manera excepcional, presupuestos en los que no se exige el asunto previo, cuando por la naturaleza del asunto, no exista una lesión individual y directa, o se trate de la defensa de intereses difusos o colectivos, o bien cuando es formulada en forma directa por el Contralor General de la República, el Procurador General de la República, el Fiscal General de la República y el Defensor de los Habitantes.

Asimismo, existen otras formalidades que deben ser cumplidas, a saber, la determinación explícita de la normativa impugnada, debidamente fundamentada, con cita concreta de las normas y principios constitucionales que se consideren infringidos, la autenticación por abogado del escrito en el que se plantea la acción, la acreditación de las condiciones de legitimación (poderes y certificaciones), así como la certificación literal del escrito en el que se invocó la inconstitucionalidad de las normas en el asunto base, requisitos todos que en caso de no ser cumplidos por el accionante, dan lugar a la inadmisión de la acción.

II.Sobre el incumplimiento de los requisitos de admisibilidad en esta acción de inconstitucionalidad. Una vez analizado el escrito de interposición de este proceso, se concluye que adolece de requisitos esenciales para plantear la acción, razón por la cual lo procedente es su rechazo de plano. En primer término, el accionante omite justificar en cuál supuesto del artículo 75 de la Ley de la Jurisdicción Constitucional basa su legitimación y, aun cuando, se admitiera la misma por la defensa de intereses corporativos, al representar el accionante a la Cámara de Industria, Comercio y Servicios del cantón de la Unión, advierte este Tribunal, de la propia personería jurídica aportada por el gestionante, que el objetivo de esa asociación es el siguiente: “PROMOVER EL DESARROLLO DE LA INDUSTRIA, COMERCIO Y SERVICIOS EN EL CANTON DE LA UNION, GENERAR UN CANAL DE COMUNICACION Y ENLACE DIRECTO CON ACTORES POLITICOS Y AUTORIDADES ADMINISTRATIVAS EN DEFENSA DEL SECTOR EMPRESARIAL. CREAR UN ESPACIO DE DISCUSION Y ELABORACION DE PROPUESTAS PARA LA MEJORA DE LAS CONDICIONES DE EMPRENDURISMO”. Es decir, entre sus potestades no está la defensa judicial de sus agremiados, ni la posibilidad de plantear procesos contra normas. Por consiguiente, carece de legitimación para ejercerla mediante este proceso. En virtud de todo lo expuesto, procede rechazar de plano la acción.

III.Voto salvado del magistrado Rueda Leal. Me separo del criterio de la mayoría de este Tribunal y salvo el voto en este asunto, por considerar que la decisión de rechazar de plano esta acción de inconstitucionalidad es prematura. Es incuestionable que la acción de inconstitucionalidad es un proceso, “instaurado con el propósito de garantizar la supremacía de la Constitución Política frente a normas u otras disposiciones de carácter general y que por esa misma razón deben cumplirse un conjunto de formalidades, a efecto de que la Sala pueda válidamente conocer el fondo de la impugnación” como se ha señalado en la amplia jurisprudencia de esta Sala. Sin embargo, es precisamente la propia ley la que ordena el tratamiento que debe darse a las distintas formalidades y a su eventual incumplimiento, como se extrae del texto del artículo 80 de la Ley de la Jurisdicción Constitucional que señala:

“Artículo 80.- Si no se llenaren las formalidades a que se refieren los dos artículos anteriores, el Presidente de la Sala señalará por resolución, cuáles son los requisitos omitidos y ordenará cumplirlos dentro de tercero día (…)” En este asunto, entre otros requisitos, se echa de menos una fundamentación adecuada y suficiente tal y como lo exige el artículo 78 de la Ley de la Jurisdicción Constitucional, por lo que resulta de incuestionable aplicación la prevención al accionante para que remedie la omisión detectada. De igual forma, no sobra en absoluto dejar sentado que –en mi criterio- tanto la interpretación de los artículos 78 y 79 como la del propio 80 de la Ley que rige esta jurisdicción, debe ser amplia en beneficio de quienes acuden a esta Sala, de modo que el acceso a la justicia constitucional no resulte innecesariamente limitado.

IV.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano la acción. El magistrado Rueda Leal salva el voto y ordena hacer la prevención del artículo 80 de la Ley de la Jurisdicción Constitucional.
