Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine fifteen a.m. on December twenty-two, two thousand twenty-three.
Amparo appeal (recurso de amparo) filed by [Nombre62 001], identity card No. [Valor 001], against the MUNICIPALIDAD DE ALAJUELA.
Facts:
That, in parallel with the intervention to identify the properties that are illegally discharging wastewater (vertido ilegal de aguas residuales) into the stormwater system (sistema pluvial), a design and budget will be prepared in an effort to allocate resources to improve stormwater management and thereby address the needs of the residents of the Santa Fe urban development. 7. That any work our institution may undertake to improve stormwater management is contingent upon the complete elimination of wastewater discharges by property owners in the Santa Fe urban development, since improvements to stormwater conveyance cannot be made while wastewater discharges persist, as the latter disrupt water conveyance because they contain heavy waste materials that behave improperly when flowing through gutters or stormwater pipes, settling and causing obstructions in the system.” They clarify that the appellant’s assertion that “(...) they have been insisting upon and requesting the intervention of the respondent Municipality for more than 2 years, without anything having been done to date (...)” is untrue; she has received responses from the Administration.
Nevertheless, the petitioner demands that she be given a specific date; however, the Coordinator of the Storm Sewer Activity (Actividad de Alcantarillado Pluvial) informed her that “(...) I wish to indicate that, once the budget had been prepared, we determined that a specific budget allocation is necessary to carry out the project, given the costs required to address the situation and, principally, because our activity does not have the appropriate machinery for its construction. We will therefore propose the project so that the Administration may assess its priority and determine the feasibility of allocating resources to it (...)”. In summary, the appellant’s demand that she be given a specific date cannot be met because, in addition to this not being a matter subject to the Administration’s whim, it is reiterated for the information of the Sala Constitucional and the petitioner herself that the Municipalidad is subject to budgetary constraints and that it would be highly irresponsible to give the claimant a date when the Administration has no certainty that the works will be carried out. They request that the appeal (recurso) be dismissed.
Justice Araya García drafts the opinion; and,
Considering:
I.Preliminary Issue. Before analyzing the merits of the matter—concerning the alleged violation of the right to prompt and proper proceedings—it must be clarified that, since judgment No. 2008-02545, issued at 8:55 on 22 de febrero de 2008, this Chamber has referred to the contentious-administrative jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding—initiated ex officio or at the request of a party—through a final administrative act (acto final), or to hear the applicable administrative appeals (recursos administrativos). This case specifically presents an exception, since it concerns an environmental complaint (denuncia ambiental) that allegedly was not resolved within a reasonable period by the Municipalidad de Alajuela. Having clarified this point, the Chamber proceeds to rule on the specific situation raised in this amparo proceeding (amparo).
II.Subject Matter of the Appeal. The appellant alleges that on 26 de setiembre de 2022 she filed a complaint with the Municipalidad de Alajuela regarding the poor condition of the storm drains in Urbanización Santa Fe. She complains that she has been following up for more than two years and that the local government has not provided a solution, resulting in pollution, foul odors, and unsanitary conditions, which endanger the health of the area’s residents.
On 29 de junio de este año, I approached Mr. Diego Corrales, who told me that once the budget was available, a letter had to be prepared requesting consideration of its inclusion in the budget; I have continued to inquire, even through Whatsapp messaging, but still have not received a response. The budget and what I need concern the replacement of the drainage ditches; regarding this matter, which is already being processed, I have not been provided with a response” (see the report of the respondent authorities).
A visit was made to the community, and it was determined that, although the stormwater system requires improvements due to normal deterioration over the years, the fundamental problem faced by the residents of urbanización Santa Fe results from a situation they themselves created, because the problem lies in the improper disposal of wastewater (aguas residuales), which is being illegally discharged into the stormwater system. 3. Subsequently, by means of official letter No. MA-A-5261-2022, the Municipal Mayor’s Office made a follow-up inquiry concerning official letter No. MA-AAP-0822-2022, requesting information on the estimated period in which work was scheduled in urbanización Santa Fe. That official letter was duly answered by means of official letter No. MA-AAP-0947-2022, of November 02, 2022, stating that ‘at this time, we cannot provide an exact date because the work we perform is carried out as progress is made, both on the work currently under way and on the work scheduled prior to the intervention in Urbanización Santa Fe. …,’ as the petitioner herself notes in the Recurso de Amparo.
Furthermore, that official letter (MA-AAP-0947-2023) advised that ‘we are evaluating the situation in order to carry out an intervention throughout the stormwater system of this Urbanización, in accordance with the financial resources available to us for the year 2023.’ 4. The work required to address the stormwater system in urbanización Santa Fe extends for more than 1000 meters, and therefore the budget exceeds the investments that may be carried out through the Ordinary Activity (institutional crews, machinery, and equipment), since the amount could exceed 50 million colones. It should also be noted that, with the entry into force of the Ley de Contratación Pública, environmental factors are among the factors to be evaluated in the pre-investment analysis (análisis de pre-inversión) for the execution of public works projects; therefore, before any project proposal is made, compliance with all standards established for sound environmental management (gestión ambiental) must be evaluated. 5.
During the inspections conducted, the presence of wastewater was confirmed; therefore, before any potential project is undertaken, the illegal discharge of wastewater into the stormwater system must be corrected. To this end, one or more inspections are expected to be coordinated with the Ministerio de Salud, the agency with jurisdiction over this matter pursuant to the Ley General de Salud, article 292, during January 2024, in order to identify more efficiently the properties that use the stormwater system to dispose of wastewater improperly. This action is planned for the months of January and February 2024, since it is more efficient to conduct tests to detect illegal situations during that period, because in the rainy season the presence of rainfall increases the difficulty and, therefore, increases the flow circulating through stormwater systems. 6. Concurrently with the intervention to identify the properties that illegally discharge wastewater into the stormwater system, the design and budget will be prepared in an effort to allocate resources for improving stormwater management and thereby addressing the needs of the residents of urbanización Santa Fe. 7.
Any work that our institution may undertake to improve stormwater management is contingent upon the complete elimination of wastewater discharges by property owners in urbanización Santa Fe, because improvements to stormwater conveyance cannot be made while wastewater discharges continue, since the latter alter water conveyance because they contain heavy waste that behaves improperly when flowing through gutters or stormwater pipes, settling and causing blockages in the system” (see report of the respondent authorities).
It should be noted that the petitioner herself submitted to the Sala Constitucional, as documentary evidence, the official letters that this Mayor’s Office sent her as part of its follow-up on the case. However, it was not until this past November 08 that we received official letter No. MA-AAP-52372023, in which Eng. Chacón Soto—although indicating that a specific budget allocation is required to execute the project—did not clarify the cost of the materials or the ‘appropriate machinery for its construction’ (folio 17). For that reason, by means of official letter NO MA-A-7233-2023 prepared today, that official has been granted a period of one day to complete that information, considering that this recurso de amparo is currently pending (folio 16). That said, we deem it necessary to indicate that, given the stage of the year in which we currently find ourselves and the fact that institutional planning for the projects to be executed was included in the Presupuesto Ordinario 2024, which is undergoing analysis and approval by the Contraloría General de la República, it must be noted that once we receive the estimate from Eng.
Lawrence Chacón Soto, we will proceed to seek resources to include the corresponding budget allocation in one of the extraordinary budgets for 2024. I am attaching the original record compiled in connection with this recurso de amparo, which contains 19 folios” (see report of the respondent authorities).
IV.Regarding the specific case. In the sub judice case (sub lite), the petitioner alleges that on September 26, 2022, she reported to the Municipalidad de Alajuela the poor condition of the storm drains in Urbanización Santa Fe. She complains that she has been insisting for more than two years and that the local government has failed to provide a solution, causing pollution, foul odors, and unsanitary conditions, thereby placing the health of the area’s residents at risk.
In this regard, according to the information provided by the authorities of the Municipalidad de Alajuela, it was established that the petitioner did in fact file the complaint in question and that, in view of this situation, the municipality has responded to the protected party’s (amparada) every submission. However, the established facts show that the respondent authority is aware of the reported problem and that it must be addressed; nevertheless, the record does not yet show any action capable of resolving the complaint submitted by the protected party, nor does it clearly indicate when the situation described therein will be addressed. It should be noted that, despite full knowledge of the situation, as of the date this action was filed, and despite the fact that more than one year had already elapsed since the original complaint was submitted, no administrative act (acto administrativo) had been issued to resolve the complaint in accordance with law, based on the identified findings and the manner in which they should be addressed.
Consequently, this Chamber finds that the period that has elapsed without the respondent authorities resolving the complaint submitted by the protected party and notifying her accordingly is disproportionate, given that more than one year has elapsed since the complaint in question was filed and it has yet to be resolved, compounded by the fact that the reported harm remains ongoing. Under this reasoning, this Chamber finds that the action must be granted, subject to the considerations set forth in the operative portion (parte dispositiva) of this judgment.
V.Conclusion. In light of the foregoing, the appropriate course is to grant the action, subject to the considerations set forth in the operative portion of this judgment.
VI.Dissenting opinion (voto salvado) of Magistrate Garro Vargas. Although I have joined the majority in cases raising similar grievances, upon further consideration I find that complaints of this type—where no serious risk to the health, physical integrity, or lives of the protected persons is apparent—must be brought through the ordinary legal channels (vías ordinarias de legalidad). This is particularly so where the record does not establish the existence of a duly identified person who requires the protection of this jurisdiction because of threats to the fundamental rights already mentioned or who belongs to a vulnerable group requiring the intervention of this Chamber.
I consider that, in such cases, the inaction should first be challenged before the authorities responsible for administering the stormwater system of Urbanización Santa Fe, located in Ciruelas, San Antonio de Alajuela, and then, if the omission persists, before the administrative litigation jurisdiction (jurisdicción contencioso-administrativa). That judicial forum, which has broader tools at its disposal, may examine and thoroughly assess the underlying complaint, evaluate the administrative conduct, issue specific orders to address the stated problem, and, of course, monitor compliance with the judgment.
In the case at bar, the petitioner alleges that the storm drains (alcantarillas) in Urbanización Santa Fe are in poor condition. Without identifying or specifying any individual, she claims that this has caused pollution problems, foul odors, flies, and an unpleasant and unsanitary environment, among other adverse effects that violate the residents’ rights and endanger the health of persons living in the area. In my judgment, that element alone is sufficient to dismiss the writ of amparo (recurso de amparo). This Court has stated that, in light of the effects conferred on the writ of amparo by the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional) (arts. 41 and 49), it must be concluded that any person may file such a writ, provided that the person identifies the individuals whose fundamental rights are alleged to have been violated (see, for example, judgments numbers 2019-003879, 2021-017532 and 2022-009133, among others). Consequently, respectfully and from my perspective, it does not appear valid for this Court, based on a generic claim that residents have been affected, to hear a matter concerning administrative inaction that more properly belongs before the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa).
In addition, in this particular case, it must be noted that the report submitted under oath emphasized that the Coordinador de la Actividad de Alcantarillado Pluvial stated: “I wish to indicate that, once the budget was prepared, we determined that a specific budget allocation is necessary to carry out the project, given the costs required to address the situation and, primarily, because our department does not have the appropriate machinery for its construction; therefore, we will propose the project so that the Administration may assess its priority and determine the feasibility of allocating resources to it.” In light of these elements, I consider that a direct and imminent threat to the aforementioned fundamental rights has not been established. Rather, intervention by this Court could disrupt the proper administrative planning of the respondent municipality for the execution of works that are inherently costly and could affect the proper administration and allocation of the resources available to that entity for such purposes. Moreover, as already noted, administrative omissions of this kind that do not demonstrate an imminent threat or injury to the fundamental rights of any specific person—the petitioner refers only to the residents and persons living in the area—must be raised and resolved before the ordinary courts of law (sedes ordinarias de legalidad).
In view of the foregoing, I dissent and deny the writ of amparo.
VII.Documentation submitted to the case file (expediente). The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained in any additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the Court Clerk’s Office within a maximum period of 30 business days from the date notice of this judgment is served. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Regulation on Electronic Case Files before the Poder Judicial” (“Reglamento sobre Expediente Electrónico ante el Poder Judicial”), approved by the Corte Plena at session No. 27-11 of 22 de agosto de 2011, article XXVI, and published in Boletín Judicial No. 19 of 26 de enero de 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo de 2012, article LXXXI.
Por tanto:
The writ is granted. Humberto Soto Herrera and Lawrence Chacón Soto, respectively Alcalde and Coordinador de la Actividad de Alcantarillado Pluvial, both of the Municipalidad de Alajuela, or whoever holds those offices, are ordered to take the measures falling within the scope of their authority and to establish the necessary interinstitutional actions and coordination so that, within a maximum period of two months from the date notice of this judgment is served, the appropriate coordination is carried out, all pertinent actions are taken to provide a definitive solution to the problem raised, and the petitioner is formally informed of the actions taken and decisions reached. The respondents are warned that failure to comply with this order will constitute the offense of disobedience and that, pursuant to article 71 of the Law governing this jurisdiction, any person who receives an order issued in a writ of amparo proceeding that the person is required to comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The Municipalidad de Alajuela is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified in proceedings to enforce the judgment before the contentious-administrative jurisdiction. Magistrada Garro Vargas dissents and denies the writ of amparo. Let notice be served.- Nombre152 C.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veintidos de diciembre de dos mil veintitres .
Recurso de amparo interpuesto por [Nombre62 001], cédula de identidad No. [Valor 001], contra la MUNICIPALIDAD DE ALAJUELA.
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Cuestión Preliminar. De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción, pues, se está ante una denuncia ambiental, la cual, presuntamente, no ha sido resuelta dentro de un plazo razonable por parte de la Municipalidad de Alajuela. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
II.Objeto del recurso. Alega la recurrente que el 26 de setiembre de 2022 denunció ante la Municipalidad de Alajuela el mal estado de las alcantarillas de la Urbanización Santa Fe. Reclama que tiene más de dos años de insistir y el gobierno local no ha brindado una solución, provocando problemas de contaminación, malos olores e insalubridad, lo cual pone en riesgo la salud de las personas habitantes de la zona.
Se realizó una visita a la comunidad y se pudo identificar que, si bien el sistema pluvial requiere de mejoras debido al deterioro normal producto del paso de los años, la problemática fundamental que poseen los vecinos de urbanización Santa Fe es producto de una situación generada por ellos mismos, estos por cuanto el malestar radica en la inadecuada disposición de las aguas residuales, ya que de forma ilegal estas aguas se vierten hacia el sistema pluvial. 3. Posteriormente, mediante el oficio No. MA-A-5261-2022, la Alcaldía Municipal realiza consulta de seguimiento al oficio No. MA-AAP-0822-2022, solicitando información sobre la estimación del periodo en el cual se tienen programadas obras en la urbanización Santa Fe. Este oficio fue debidamente respondido mediante el oficio No. MA-AAP-0947-2022, del 02 de noviembre de 2022 y en el se señala que “en este momento no podemos indicar una fecha exacta, debido a que los trabajos que desarrollamos se van efectuando conforme se logra avanzar, tanto en las obras que se desarrollan actualmente, como en las que se tienen programadas previo a la intervención en la Urbanización Santa Fe. …”, tal y como lo apunta la propia recurrente en el Recurso de Amparo.
Además, en dicho oficio (MA-AAP-0947-2023), se hizo de conocimiento que “nos encontramos evaluando la situación, para realizar una intervención en todo el sistema pluvial de esta Urbanización. de acuerdo con las capacidades económicas que contamos para el año 2023”. 4. Que, los trabajos para la atención del sistema pluvial en urbanización Santa Fe poseen un alcance superior a los 1000 metros, por lo que el presupuesto excede las inversiones que pueden llevarse a cabo por medio la Actividad Ordinaria (cuadrillas, maquinaria y equipos de la institución), puesto que el monto podría exceder los 50 millones de colones. Además, debe señalarse que, con la entrada en vigor de la Ley de Contratación Pública, uno de los factores evaluables dentro del análisis de pre-inversión para la ejecución de proyectos de obra pública son los factores ambientales, por lo que debe evaluarse previo a cualquier propuesta de proyecto el cumplimiento de todas las normas establecidas para una buena gestión ambiental. 5.
Que, durante las inspecciones llevadas a cabo, se pudo comprobar la presencia de aguas residuales, por lo que previo al desarrollo de cualquier proyecto que pueda llevarse a cabo, se debe corregir el vertido ilegal de aguas residuales al sistema pluvial. Para ello, se tiene previsto coordinar con el Ministerio de Salud, ente competente en esta materia según lo establecido en la Ley General de Salud, artículo 292, una o varias inspecciones durante el mes de enero de 2024, para determinar de una manera más eficiente las propiedades que utilizan el sistema pluvial para disponer de manera inadecuado las aguas residuales. Esta situación se tiene prevista para desarrollarse en los meses de enero y febrero de 2024, ya que resulta más eficiente la efectuar las pruebas para detectar situaciones ilegales, debido a que durante la estación lluviosa la dificultad aumenta debido a la presencia de lluvias y, por tanto, existe un aumento en el flujo de circula por los sistemas pluviales. 6.
Que, paralelo a la intervención para ubicar las fincas que realizan el vertido ilegal de aguas residuales al sistema pluvial, se realizará el diseño y presupuesto para procurar destinar recursos que permitan realizar el mejoramiento en el manejo de las aguas pluviales y poder de esta manera, brindar atención a la necesidad que poseen los vecinos de la urbanización Santa Fe. 7. Que, cualquier trabajo que pueda desarrollar nuestra institución en pro de mejorar el manejo de las aguas pluviales, está sujeto a la eliminación total de las descargas de aguas residuales por parte de los propietarios de inmuebles de la urbanización Santa Fe, ya que no posible realizar mejoras en la conducción de las aguas pluviales cuando se presentan descargas de aguas residuales, ye que estas últimas alteran el la conducción de las aguas, puesto que en ellas se encuentran desechos pesados que se comportan inadecuadamente cuando fluyen a través de cunetas o tuberías pluviales, sedimentándose y provocando obstrucciones en el sistema” (ver informe de las autoridades recurridas).
Nótese que la misma recurrente presenta como prueba documental ante la Sala Constitucional los oficios que esta Alcaldía le ha enviado como parte del seguimiento dado al caso. Sin embargo, es hasta el pasado 08 de noviembre en curso que recibimos el oficio No. MA-AAP-52372023, mediante el cual el Ing. Chacón Soto -si bien indica que se requiere contar con una partida específica para ejecutar el proyecto-, lo cierto es que no se aclara el costo de los materiales ni la “maquinaria idónea para su construcción” (folio 17). Por tal razón, mediante el oficio NO MA-A-7233-2023 elaborado el día de hoy, se ha otorgado un plazo de un día para que dicho funcionario se sirva completar dicha información, considerando que se encuentra en trámite el presente recurso de amparo (folio 16). Ahora bien, consideramos necesario indicar que debido a la etapa del año en que nos encontramos y que la planificación institucional de los proyectos a ejecutar fue incluida en el Presupuesto Ordinario 2024, mismo que está en proceso de análisis y aprobación por parte de la Contraloría General de la República, es necesario acotar que, una vez que contemos con la estimación por parte del Ing. Lawrence Chacón Soto, procederemos a buscar recursos para la inclusión de la partida correspondiente en alguno de los presupuestos extraordinarios del año 2024. Adjunto el expediente original conformado con ocasión del presente recurso de amparo, el cual contiene 19 folios” (ver informe de las autoridades recurridas).
IV.Sobre el caso concreto. En el sub lite, la recurrente alega que el 26 de setiembre de 2022, denunció ante la Municipalidad de Alajuela el mal estado de las alcantarillas de la Urbanización Santa Fe. Reclama que tiene más de dos años de insistir y el gobierno local no ha brindado una solución, provocando problemas de contaminación, malos olores e insalubridad, lo cual pone en riesgo la salud de las personas habitantes de la zona.
Al respecto, según lo informado por las autoridades de la Municipalidad de Alajuela, se tuvo por demostrado que, efectivamente, la recurrente presentó la denuncia en cuestión y en virtud de esta situación, el municipio ha procedido a brindarle a la amparada respuesta a todas las gestiones presentadas; sin embargo, de la relación de hechos probados se evidencia que la autoridad recurrida tiene conocimiento del problema denunciado y de que este debe ser atendido; no obstante, de los autos no se evidencia aún que exista actuación alguna que pueda resolver la denuncia planteada por la parte tutelada ni tampoco se indica de manera clara cuándo será atendida la situación que se plantea en ella. Nótese que, pese al pleno conocimiento de la situación, a la fecha de presentación de este recurso, y pese a que transcurrió ya más de un año desde la presentación de la denuncia original, no se ha emitido acto administrativo alguno para resolver como en derecho corresponda la denuncia planteada, con base a los hallazgos identificados y el abordaje que deba darse a los mismos.
En consecuencia, estima esta Sala que el plazo que ha transcurrido para resolver la denuncia planteada por la parte tutelada y comunicarle lo respectivo por parte de las autoridades recurridas es desproporcionado, por cuanto, ha transcurrido un plazo de, más de un año, desde la presentación de la denuncia apuntada, sin que a la fecha esta haya sido resuelta, con el agravante que la afectación denunciada continúa vigente. Bajo esta inteligencia, considera esta Sala que el recurso debe ser declarado con lugar, con las consideraciones que se dirán en la parte dispositiva de esta sentencia.
V.Conclusión. En mérito de lo expuesto, lo procedente es declarar con lugar el recurso con las consideraciones que se dirán en la parte dispositiva de esta sentencia.
VI.Voto salvado de la Magistrada Garro Vargas. Pese a que he concurrido con el voto en asuntos donde se plantean similares agravios, bajo una mejor ponderación estimo que este tipo de reproches ‒en los cuales no se aprecia un grave riesgo para la salud, integridad física o la vida de las personas amparadas‒ se deben plantear en las vías ordinarias de legalidad. Lo anterior, máxime si, de los autos, no se constata la existencia de una persona debidamente individualizada que requiera del amparo de esta jurisdicción por las amenazas a los derechos fundamentales ya indicados o que pertenezca a un grupo vulnerable que demanda la intervención de esta Sala.
Considero que en tales supuestos procede, en primer término, cuestionar la inactividad ante las autoridades competentes en administrar el sistema pluvial de la Urbanización Santa Fe, ubicada en Ciruelas, San Antonio de Alajuela y luego, de mantenerse la conducta omisa, ante la jurisdicción contencioso-administrativa. Dicha instancia jurisdiccional, con mayores herramientas, puede conocer con profundidad y sopesar la denuncia de fondo, valorar la conducta administrativa, dictar mandatos específicos para atender la problemática apuntada y, por supuesto, dar seguimiento a lo ordenado en sentencia.
En el sub lite, la recurrente acusa el mal estado de las alcantarillas de la Urbanización Santa Fe. Por ello, sin ninguna determinación subjetiva o individualización, aduce que esto ha provocado problemas de contaminación, malos olores, moscas, aspecto desagradable e insalubre, entre otras afectaciones que vulneran los derechos de los vecinos y ponen en riesgo la salud de las personas habitantes de la zona. Ya solo ese elemento, en mi criterio, es suficiente para desestimar el recurso de amparo. Este Tribunal ha advertido que partiendo de los efectos que la Ley de la Jurisdicción Constitucional confiere al recurso de amparo (arts. 41 y 49) debe concluirse que cualquier persona puede interponerlo, siempre y cuando individualice a los sujetos cuyos derechos fundamentales considera fueron conculcados (ver, por ejemplo, las sentencias números 2019-003879, 2021-017532 y 2022-009133, entre otras). En consecuencia, respetuosamente y desde mi perspectiva, no luce válido que a tenor de un argumento genérico de la afectación a vecinos se conozca en esta sede sobre una inactividad administrativa que más corresponde ser residenciada en la jurisdicción contencioso-administrativa.
Aunado a lo anterior, en el caso concreto se hace necesario evidenciar que en el informe rendido, bajo la gravedad del juramento, se subrayó que el Coordinador de la Actividad de Alcantarillado Pluvial señala que “me permito indicar que una vez realizado el presupuesto, pudimos determinar que es necesario contar con una partida específica para ejecutar el proyecto, dado los costos que se requieren para atender la situación y principalmente, que nuestra actividad no cuenta con la maquinaria idónea para su construcción, por lo cual estaremos proponiendo el proyecto para que la Administración valore la prioridad y determine la factibilidad de asignarle los recursos”.
A la luz de tales elementos, considero que no se encuentra acreditada una amenaza directa e inminente a los derechos fundamentales supra mencionados. Más bien, la intervención de este Tribunal podría alterar la debida planificación administrativa de la municipalidad recurrida para la ejecución de unas obras de suyo onerosas y que pueden afectar la adecuada administración y previsión de los recursos con los que cuenta dicha corporación para tales efectos. Por lo demás, como ya se advirtió, este tipo de omisiones administrativas que no evidencian una amenaza o lesión inminente a los derechos fundamentales de alguna persona en concreto ‒la recurrente únicamente refiere los vecinos y personas habitantes de la zona ‒ deben ser planteadas y resueltas en las sedes ordinarias de legalidad.
En virtud de lo expuesto, salvo el voto y declaro sin lugar el recurso de amparo.
VII.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Humberto Soto Herrera y Lawrence Chacón Soto, por su orden Alcalde y Coordinador de la Actividad de Alcantarillado Pluvial, ambos de la Municipalidad de Alajuela, o a quienes ocupen el cargo, que realicen las actuaciones que estén dentro del ámbito de sus competencias y establezcan las acciones y coordinaciones interinstitucionales necesarias, para que en el plazo máximo de dos meses contados a partir de la notificación de esta sentencia, se realicen las coordinaciones que correspondan se realicen todas las acciones que resulten pertinentes para dar solución definitiva a la problemática planteada, y se informe de manera formal a la parte recurrente de lo actuado y resuelto. Se les advierte a los recurridos que, de no acatar la orden dicha, incurrirán en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Alajuela al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La Magistrada Garro Vargas salva el voto y declara sin lugar el recurso de amparo. Notifíquese.- Nombre152 C.
