Amparo proceeding (recurso de amparo) filed by [Nombre62 001], identity card number [CED62 ], against the MUNICIPALIDAD DE ALAJUELA.

BACKGROUND

  1. 1By a written submission entered into the electronic case file on 21 de octubre de 2023, the petitioner filed an amparo proceeding against the Municipalidad de Alajuela. He states that on 29 de setiembre de 2023, through a request submitted via the Integrated Customer Service Platform—official letter No. LA-PR0058, transaction No. 44629-1012—he requested the following from the Concejo Municipal de Alajuela: “(…) 1- I respectfully ask you to inform me whether, in compliance with the principle of legality under Article 11 of the Constitution and Articles 11 and 13 of the Ley General de Administración Pública, the action indicated in official letter SETENA-DT-EAE-046- 2022 (of which the Council was aware), as well as that communicated to the Municipality at the meeting of 25 de Agosto de 2021, was carried out and, if not, why not? I quote the relevant passage: ‘If the zoning (zonificación) proposed for the Plan Regulador de Alajuela differs from the proposed zoning for which Nombre3456 granted environmental viability (viabilidad ambiental) in Decision No. 2113-2020-SETENA, the requirements stated in the fifth operative provision of that decision must be met....’ Additionally, I ask whether the requirements established in the seventh recital of that decision were met, which states: ‘The Municipalidad de Alajuela shall respect the conditions stipulated in the documentation concerning the Incorporation of the Environmental Variable into the Plan Regulador de Alajuela, including limitations, potential uses, and land-use recommendations, as well as the environmental guidelines specified for each zone under the proposed zoning, all in accordance with the final version of the following studies: Environmental Fragility Indices, Environmental Scope Analysis, and Sustainable Development Regulations, included in administrative case file No. EAE-01-2018-SETENA.’ 2- Regarding the vote on official letter MA-A-5526-2023 last Martes 19 de Setiembre, under Chapter XI, REPORTS OF Nombre20749 AND DEPUTY Nombre20749, and the statement in official letter MA-PPCI0782-2A23, which I quote below: ‘In response to the request made by the Concejo Municipal de Alajuela, I hereby submit the final version of the proposed new Regulatory Plan (Plan Regulador), which contains the revisions and updates recommended by the Comisión Específica del Plan Regulador (CEPR) and approved by the Concejo Municipal,’ I respectfully ask you to inform me at which session and through which resolution those revisions and updates were approved by the Council (…)”.He explains that the request is straightforward, as it asks whether they complied with national regulations governing the processing of zoning changes associated with the environmental viability granted by Nombre3456 through Decision No. 2113-2020-SETENA, and whether the Council approved the changes recommended by the Comisión Específica del Plan Regulador before the session of 19 de setiembre; however, when he sought amparo relief, his petition had not been addressed. He requests that the proceeding be granted.
  2. 2By decision issued at 16:24 hrs. on 25 de octubre de 2023, the present amparo proceeding was admitted, and the person holding the office of President of the Concejo de la Municipalidad de Alajuela was ordered to respond.
  3. 3Randall Barquero Piedra, in his capacity as President of the Concejo de la Municipalidad de Alajuela, submits a report under oath and states: “Transaction N° 44629-2023 of the Integrated Customer Service System Subprocess was delivered to the Municipal Presidency on 02 de octubre del 2023. It should be noted that it is the same document and is addressed to Licda. Kathia Maroeia Guzmán Cerdas, Acting President of the Concejo Municipal de Alajuela. In addition, transaction BG-1229-2023, concerning transaction N.° 44630-2023 of the Integrated Customer Service System Subprocess, which was forwarded with a copy to the Comisión Específica del Plan Regulado, was considered by the Concejo Municipal under Article N. 24, Chapter VII, of Ordinary Session N.° 42-2023, held on martes 17 de octubre del 2023, and the following was decided: ‘IT IS RESOLVED TO REFER THE MATTER TO THE COMISIÓN ESPECÍFICA DEL PLAN REGULADOR FOR ITS OPINION.IT RECEIVES ELEVEN AFFIRMATIVE VOTES. FINALLY APPROVED.’ (Transaction BG-1229-2023 and a copy of official letter MASCM-2611- 2023 are attached.) There is another transaction filed by the petitioner, through which transaction BG-1230-2023, transaction N.° 44632-2023 of the Integrated Customer Service System Subprocess, copied to the Concejo Municipal, was considered by the Concejo Municipal under Article N.° 25, Chapter VII, of Ordinary Session N.° 42-2023 of martes 17 de octubre de! 2023, and the following was decided: ‘IT IS RESOLVED TO ACKNOWLEDGE RECEIPT OF TRANSACTION BG1230-2023. IT RECEIVES ELEVEN AFFIRMATIVE VOTES. FINALLY APPROVED.’ (Transaction BG-1 230-2023 and official letter MA-SCM-2612-2023 are attached.) Nevertheless, it is extremely important to emphasize that, even though the transaction is currently before the Comisión Especifica del Plan Regulador for its opinion, it is also extremely important to inform the Constitutional Chamber that, pursuant to the Internal Regulations on Order, Governance, and Debate of the Concejo Municipal del cantón Central de Alajuela, specifically Chapter V1ì1, concerning ‘Working Committees,’ Article 52 establishes the statutory period for deciding matters submitted to committees, under subsection 1), which states: ‘Standing and special committees must decide every matter submitted for their consideration within 60 calendar days, counted from the day following its receipt by the Committee Secretariat.’ Accordingly, the 60-calendar-day period following receipt of the document is still running, and there remains time to respond to the petitioner’s request, considering that it was received by that Committee on 23 de octubre de! año en curso, under official letter N° MA-SCM-261 1-2023 (attached to transaction N° BG-1229-2023 TRANSACTION 44630-2023), a fully justified period that, according to the calculations, does not expire until 22 de diciembre de 2023.In view of the foregoing, we consider the filing of this amparo proceeding to be, in my opinion, premature, because the petitioner filed it despite knowing the period granted by law and because, among the various transactions he submitted, one was merely acknowledged as received, since his inquiry was already before the appropriate committee for its respective opinion. Based on the foregoing, it is established that no administrative acts have violated his constitutional rights. Accordingly, it is demonstrated that the Concejo Municipal has acted diligently and performed the duties falling within its jurisdiction; I therefore request that the amparo proceeding be DISMISSED in its entirety and that the petitioner be ordered to pay the costs of this action.” He requests that the proceeding be dismissed.
  4. 4In a written submission dated 14 de noviembre de 2023, the petitioner rebutted the report submitted by the respondent authority.
  5. 5The statutory requirements have been observed in the conduct of the proceeding.

Justice Araya García writes the opinion; and,

CONSIDERING:

I. SUBJECT MATTER OF THE PROCEEDING

The petitioner complains that, as of the date this amparo proceeding was filed, the President of the Council had not responded to the request he submitted on 29 de setiembre de 2023 to the Municipalidad de Alajuela regarding the approval process for the Plan Regulador de Alajuela. He considers that his right of petition (derecho de petición) and right of access to administrative information (acceso a la información administrativa) were violated.

II. PROVEN FACTS

The following facts are deemed established and relevant to the decision in this matter:

  • 1)On 29 de setiembre de 2023, the petitioner requested the following information from the President of the Concejo de la Municipalidad de Alajuela: “I respectfully ask you to inform me whether, in compliance with the principle of legality under Article 11 of the Constitution and Articles 11 and 13 of the Ley General de Administración Pública, the action indicated in official letter SETENA-DT-EAE-046- 2022 (of which the Council was aware), as well as that communicated to the Municipality at the meeting of 25 de Agosto de 2021, was carried out and, if not, why not? I quote the relevant passage: ‘If the zoning proposed for the Plan Regulador de Alajuela differs from the proposed zoning for which Nombre3456 granted environmental viability in Decision No. 2113-2020-SETENA, the requirements stated in the fifth operative provision of that decision must be met....’ Additionally, I ask whether the requirements established in the seventh recital of that decision were met, which states: ‘The Municipalidad de Alajuela shall respect the conditions stipulated in the documentation concerning the Incorporation of the Environmental Variable into the Plan Regulador de Alajuela, including limitations, potential uses, and land-use recommendations, as well as the environmental guidelines specified for each zone under the proposed zoning, all in accordance with the final version of the following studies: Environmental Fragility Indices, Environmental Scope Analysis, and Sustainable Development Regulations, included in administrative case file No. EAE-01-2018-SETENA.’ 2- Regarding the vote on official letter MA-A-5526-2023 last Martes 19 de Setiembre, under Chapter XI, REPORTS OF Nombre20749 AND DEPUTY Nombre20749, and the statement in official letter MA-PPCI0782-2A23, which I quote below: ‘In response to the request made by the Concejo Municipal de Alajuela, I hereby submit the final version of the proposed new Regulatory Plan, which contains the revisions and updates recommended by the Comisión Específica del Plan Regulador (CEPR) and approved by the Concejo Municipal,’ I respectfully ask you to inform me at which session and through which resolution those revisions and updates were approved by the Council.

I would greatly appreciate your taking into account the statements in the aforementioned official letters and requesting from Nombre3456, if appropriate, the corresponding adjustment to the environmental viability of the proposed Regulatory Plan before approval of the notice convening the Public Hearing (Audiencia Pública), in view of the substantial changes that the proposal underwent between the date environmental viability was granted and the present date (…)” (copy of the request bearing a receipt stamp).

  • 2)The petitioner’s request was assigned transaction number 0044629-2023 (see evidence).
  • 3)The protected party’s request was considered by the Concejo Municipal under Article N. 24, Chapter VII, of Ordinary Session N.° 42-2023 of 17 de octubre del 2023, and the following was ordered: “IT IS RESOLVED TO REFER THE MATTER TO THE COMISIÓN ESPECÍFICA DEL PLAN REGULADOR FOR ITS OPINION. IT RECEIVES ELEVEN AFFIRMATIVE VOTES. FINALLY APPROVED.” (see report) 4) Through official letter MA-SCM-2612-2023 of 23 de octubre de 2023, the Coordinator of the Municipal Council Secretariat Subprocess notified the protected party of the resolution referenced in the immediately preceding proven fact (see official letter submitted in the case file).
  • 5)To date, no response has been provided to the protected party’s request (see report).

III. THE RIGHT OF PETITION AND ACCESS TO PUBLIC INFORMATION

Article 27 of the Political Constitution enshrines the right of every person, whether an individual or a legal entity, to petition any public body or entity regarding a matter of interest to that person. The Administration must decide such a petition promptly, reasonably, consistently, effectively, and within a brief period.

Furthermore, Article 30 of the Political Constitution guarantees free access to administrative departments for the purpose of obtaining information on matters of public interest. This right is not unrestricted—since, like every constitutional right, it is subject to limitations—as State secrets remain protected. The aim is thus to ensure a transparent administrative function that allows individuals to access information of a public nature held by the various public entities or bodies.

Along these lines, the case law of this Chamber has clearly established that both rights require the Administration to take clear, affirmative action in response to a citizen’s request, while respecting the established response deadlines. Thus, if the request cannot be resolved because of the nature of the matter, the Administration is required to explain, within the period prescribed by law, why the request cannot be fulfilled.

IV. SPECIFIC CASE

The established facts show that, by means of a written submission filed on 29 de setiembre de 2023, the petitioner requested the following information from the President of the Concejo de la Municipalidad de Alajuela: “Please inform me whether, in compliance with the principle of legality under Article 11 of the Constitution and Articles 11 and 13 of the Ley General de Administración Pública, the action indicated in official letter SETENA-DT-EAE-046- 2022 (known to the Concejo) was taken, as well as that reported to the Municipalidad at the meeting of 25 de Agosto de 2021, and, if not, why not? I quote the relevant passage: ‘If the zoning proposed for the Plan Regulador de Alajuela differs from the proposed zoning for which Nombre3456 granted environmental approval (viabilidad ambiental) in Res. No. 2113-2020-SETENA, the requirements set forth in the fifth operative provision of that resolution must be fulfilled...’.

Additionally, please indicate whether the requirements established in the seventh whereas clause of that resolution were fulfilled, which states: ‘The Municipalidad de Alajuela shall comply with the conditions stipulated in the documentation concerning the Incorporación de la Variable Ambiental del Plan Regulador de Alajuela, including constraints, potential uses, and land-use recommendations, as well as the environmental guidelines specified for each zone according to the proposed zoning; all in accordance with the final version of the following studies: Índices de Fragilidad Ambiental, Análisis de Alcance Ambiental and Reglamento de Desarrollo Sostenible, included in administrative expediente No. EAE-01-2018-SETENA.’ 2- Regarding the vote on official letter MA-A-5526-2023 held last Martes 19 de Setiembre under Chapter XI. REPORTS OF Nombre20749 AND DEPUTY Nombre20749, and the statement in official letter MA-PPCI0782-2A23, which I quote below: ‘In response to the request made by the Concejo Municipal de Alajuela, I hereby submit the final version of the proposal for the new Plan Regulador, which contains the adjustments and updates recommended by the Comisión Específica del Plan Regulador (CEPR) and approved by the Concejo Municipal,’ please inform me at which session and by means of which resolution those adjustments and updates were approved by the Concejo.

I would greatly appreciate it if you would take into account the statements made in the aforementioned official letters and request from Nombre3456, if appropriate, the corresponding adjustment to the environmental approval for the proposed Plan Regulador prior to approving the call for a Public Hearing, in view of the substantial changes made to that proposal between the date on which environmental approval was granted and the present date (…)” (copy of the request bearing a receipt stamp). That request was assigned proceeding number 0044629-2023 and was considered by the Concejo Municipal under Article N. 24, Chapter VII, of Ordinary Session N.° 42-2023 of 17 de octubre de 2023, at which it was ordered: “IT IS HEREBY RESOLVED TO REFER THE MATTER TO THE COMISIÓN ESPECÍFICA DEL PLAN REGULADOR FOR ITS OPINION. ELEVEN AFFIRMATIVE VOTES. FINALLY APPROVED.” To date, no response has been provided to the protected party (see report).

In the report, the respondent authority stated: “(…) the proceeding is currently before the Comisión Específica del Plan Regulador for its Opinion, and it is of the utmost importance to inform the Sala Constitucional that, pursuant to the Reglamento interior de Orden Dirección y Debates del Concejo Municipal del cantón Central de Alajuela, specifically Chapter VIII, concerning ‘Working Committees,’ Article 52 establishes the statutory period for deciding matters submitted to the committees, which is the period set forth in subsection 1), providing that: ‘The standing and special committees must decide every matter submitted for their consideration within a period of 60 calendar days, counted from the day following its receipt by the Committee Secretariat.’ Accordingly, the period of 60 calendar days from receipt of the document remains in effect, and the time for responding to the petitioner’s request has not expired, taking into account that the document was received by that Committee on 23 de octubre de! año en curso, through official letter N° MA-SCM-261 1-2023 (attached to proceeding N° BG-1229-2023 PROCEEDING 44630-2023), a period that is fully justified and that, according to the calculations, does not expire until 22 de diciembre de 2023.” (report).

It is appropriate to analyze the content of the request at issue in order to determine whether the relief sought is cognizable in an amparo proceeding (amparable) and whether, as asserted, it concerns information that requires the opinion issued by the Comisión de Plan Regulador as an input. For that purpose, the following chart is provided:

REPORTS OF Nombre20749 AND DEPUTY Nombre20749, and the statement in official letter MA-PPCI0782-2A23, which I quote below: “In response to the request made by the Concejo Municipal de Alajuela, I hereby submit the final version of the proposal for the new Plan Regulador, which contains the adjustments and updates recommended by the Comisión Específica del Plan Regulador (CEPR) and approved by the Concejo Municipal,” please inform me at which session and by means of which resolution those adjustments and updates were approved by the Concejo.

Request concerning access to information Not addressed 4. I would greatly appreciate it if you would take into account the statements made in the aforementioned official letters and request from Nombre3456, if appropriate, the corresponding adjustment to the environmental approval for the proposed Plan Regulador prior to approving the call for a Public Hearing, in view of the substantial changes made to that proposal between the date on which environmental approval was granted and the present date (…)” Exhortation (excitativa) Not cognizable in an amparo proceeding As shown above, the first matters are protected by the rights of petition and access to information and have not been duly addressed. In this regard, although the respondent authority asserted that the request was sent to the Comisión del Plan Regulador for consideration, in the opinion of this Chamber, referral to that body is irrelevant to a request for information such as the one submitted, which does not require any opinion; consequently, the cited regulatory period is inapplicable because the request does not require an opinion but is instead a petition concerning a request for information. Accordingly, the amparo action must be granted on this issue.

As to the fourth matter, “I would greatly appreciate it if you would take into account the statements made in the aforementioned official letters and request from Nombre3456, if appropriate, the corresponding adjustment to the environmental approval for the proposed Plan Regulador prior to approving the call for a Public Hearing, in view of the substantial changes made to that proposal between the date on which environmental approval was granted and the present date (…)”, it constitutes an exhortation to pursue action before Nombre3456, which does not fall within the right of petition as such; therefore, the action must be dismissed with respect to this claim.

In conclusion: the violation of the petitioner’s fundamental rights is established due to the failure to address the matters identified in the chart as 1, 2, and 3; therefore, the action must be granted, while point 4, as explained above, must be dismissed because its content is not protected by the rights of petition and access to information.

V. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the court office within a maximum period of thirty business days counted from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at Session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in the Boletín Judicial N° 19 of 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

POR TANTO:

The action is partially granted. Randall Barquero Piedra, in his capacity as President of the Concejo de la Municipalidad de Alajuela, or whoever holds that office, is ordered to provide a response concerning the matters identified as numbers 1, 2, and 3 in the request submitted by the petitioner within ten days counted from notification of this judgment. The foregoing is subject to the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo action that the person is required to comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be sentenced to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Alajuela is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation court. The action is denied with respect to the exhortation to Nombre3456 contained in the request at issue. Let notice be given.- Nombre152 C.

Revisión del Documento *CED16803* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veintidos de diciembre de dos mil veintitres .

Recurso de amparo interpuesto por [Nombre62 001], cédula de identidad número [CED62 ], contra la MUNICIPALIDAD DE ALAJUELA.

RESULTANDO

  1. 1Por escrito incorporado al expediente electrónico el 21 de octubre de 2023 el recurrente interpone recurso de amparo en contra de la Municipalidad de Alajuela. Manifiesta que el 29 de setiembre de 2023, mediante gestión realizada en la Plataforma Integrada de Servicio al Cliente -oficio No. LA-PR0058, trámite No. 44629-1012-, requirió ante el Concejo Municipal de Alajuela: “(…) 1- Le ruego me indique si en cumplimiento del principio de legalidad del artículo 11 Constitucional, 11 y 13 de la Ley General de Administración Pública se realizó lo indicado en el oficio SETENA-DT-EAE-046- 2022 (de conocimiento del Concejo) así como lo informado a la Municipalidad en la reunión del 25 de Agosto de 2021 y si no, porque no?. Cito lo referido: “De ser la zonificación propuesta para el Plan Regulador de Alajuela diferente a la zonificación propuesta a la que la Nombre3456 le otorgó viabilidad ambiental en la Res. No. 2113-2020-SETENA, se debe cumplir con lo indicado en el por tanto quinto de dicha resolución...”.Adicionalmente si se cumplió con lo establecido en el considerando séptimo de dicha resolución que indica: “Deberá la municipalidad de Alajuela, respetar las condiciones estipuladas en la documentación de la Incorporación de la Variable Ambiental del Plan Regulador de Alajuela, como limitantes, potencialidades y recomendaciones de uso de la tierra, así como también los lineamientos ambientales señalados para cada zona según la zonificación propuesta; todo de conformidad como fue establecido en la versión final de los estudios: Índices de Fragilidad Ambiental, Análisis de Alcance Ambiental y Reglamento de Desarrollo Sostenible, incluidos en el expediente administrativo No. EAE-01-2018-SETENA.” 2- Con respecto a la votación del oficio MA-A-5526-2023 el pasado Martes 19 de Setiembre en el capítulo XI. INFORMES DE Nombre20749 Y VICE Nombre20749 y lo dicho en el oficio MA-PPCI0782-2A23 que cito a continuación: “Como respuesta a lo solicitado por el Concejo Municipal de Alajuela, me permito por este medio remitir la versión final de la propuesta de nuevo Plan Regulador, la cual contiene los ajustes y actualizaciones recomendados por la Comisión Específica del Plan Regulador (CEPR) y aprobados por el Concejo Municipal.", le ruego me indique en cual sesión y mediante qué acuerdo fueron aprobados por el Concejo dichos ajustes y actualizaciones (…)”.Expone que la solicitud es sencilla, pues pide que indiquen si cumplieron con la normativa nacional en cuanto a la tramitación de cambios a la zonificación relacionados con la viabilidad ambiental otorgada por la Nombre3456 mediante resolución No. 2113-2020-SETENA y si el Concejo aprobó los cambios recomendados por la Comisión Específica del Plan Regulador de previo a la sesión de 19 de setiembre; sin embargo, en el momento en que acudió en amparo, su petición no había sido atendida. Solicita que se declare con lugar el recurso.
  2. 2Por resolución de las 16:24 hrs. del 25 de octubre de 2023 se da curso al presente recurso de amparo y se concede audiencia quien ocupe el cargo de Presidente del Concejo de la Municipalidad de Alajuela.
  3. 3Rinde informe bajo juramento Randall Barquero Piedra, en su condición de Presidente del Concejo de la Municipalidad de Alajuela e indica que “El trámite N° 44629-2023 del Subproceso Sistema Integrado Servicio al Cliente, fue entregado a la Presidencia Municipal el día 02 de octubre del 2023, cabe mencionar, que es el mismo documento y se dirige a la Licda. Kathia Maroeia Guzmán Cerdas, Presidenta Concejo Municipal de Alajuela a.i. Además, el trámite BG-1229-2023 referente al trámite N." 44630-2023 del Subproceso Sistema Integrado Servicio al Cliente que fue remitido con copia a la Comisión Específica del Plan Regulado. fue conocido por el Concejo Municipal, mediante el artículo N. 24, capitulo VII de la Sesión Ordinaria N.° 42-2023 día martes 17 de octubre del 2023 y se resuelve: "SE RESUELVE TRASLADAR A LA COMISIÓN ESPECÍFICA DEL PLAN REGULADOR PARA SU DICTAMEN. OBTIENE ONCE VOTOS POSITIVOS.DEFINITIVAMENTE APROBADO". (Se adjunta el trámite BG-1229-2023 y la copia del oficio MASCM-2611- 2023). Existe otro tramite interpuesto por el recurrente, por medio del cual (Trámite BG-1230-2023, el trámite N." 44632-2023 del Subproceso Sistema Integrado Servicio al Cliente con copia al Concejo Municipal) fue conocido por el Concejo Municipal, mediante el artículo N.° 25, capítulo VII de la Sesión Ordinaria N.° 42-2023 del día martes 17 de octubre de! 2023 y se resuelve: "SE RESUELVE [JAR POR RECEBIDO EL TRÁMITE BG1230-2023. OBTIENE ONCE VOTOS POSITIVOS DEFINITIVAMENTE APROBADO". (Se adjunta el trámite BG-1 230-2023 y oficio MA-SCM-2612-2023). Sin embargo, es de suma importancia recalcar que, aun cuando el trámite se encuentra en la Comisión Especifica del Plan Regulador para su Dictamen, y es de suma importancia indicarle a la Sala Constitucional que de acuerdo con el Reglamento interior de Orden Dirección y Debates del Concejo Municipal del cantón Central de Alajuela, específicamente en el capítulo V1ì1 que se refiere a "De las Comisiones de Trabajo" en su artículo 52, refiere el plazo de ley para la resolución de los asuntos puestos en conocimiento de las comisiones que será el inciso 1) el cual indica que: "Las comisiones permanentes y especiales deben resolver todo asunto que sea puesto en su conocimiento dentro de un plazo de 60 días naturales, contando a partir del día siguiente de su recibo en la Secretaria de la Comisión" En virtud de lo anterior, el plazo de 60 días naturales, a partir del recibido del documento, se encuentra vigente y en tiempo para poder brindar respuesta a lo solicitado por el recurrente, tomando en cuenta que el mismo fue recibido en dicha Comisión el 23 de octubre de! año en curso, con el oficio N° MA-SCM-261 1-2023 (adjunto del trámite N° BG-1229-2023 TRÁMITE 44630-2023), plazo que es totalmente justificado que según los cálculos vence hasta el 22 de diciembre de 2023.En virtud de lo descrito líneas atrás, consideramos que la interposición del presente Recurso de Amparo, a mi criterio es prematuro en razón de que, el recurrente interpuso dicho recurso, aun sabiendo del plazo otorgado por la ley y que, además, en los varios trámites que presento, solo se dio por recibido el mismo, por cuando, ya su consulta se encontraba en la Respectiva comisión para su respectivo dictamen. Bajo lo anterior. se constata que, no existen actos administrativos que hayan violentado sus derechos constitucionales. En virtud de lo anterior, se comprueba que el Concejo Municipal, ha sido diligente y ha realizado las labores propias atinentes a su competencia, por lo que solicito SE DECLARE SIN LUGAR en todos sus extremos el Recurso de Amparo interpuesto y se condena a la recurrente al pago de las costas de la presente acción.” Solicita que se desestime el recurso.
  4. 4En escrito fechado 14 de noviembre de 2023, el recurrente refutó el informe rendido por la autoridad recurrida.
  5. 5En la substanciación del proceso se ha observado las prescripciones legales.

Redacta el Magistrado Araya García; y,

CONSIDERANDO:

I. OBJETO DEL RECURSO

La parte recurrente reclama que, a la fecha de interposición de este amparo, el Presidente del Concejo no ha dado respuesta a la solicitud que presentó el 29 de setiembre de 2023 en la Municipalidad de Alajuela en relación con el proceso de aprobación del Plan Regulador de Alajuela. Estima lesionado el derecho de petición y de acceso a la información administrativa.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como demostrados los siguientes hechos:

  • 1)El 29 de setiembre de 2023 el recurrente solicitó al Presidente del Concejo de la Municipalidad de Alajuela la siguiente información: “Le ruego me indique si en cumplimiento del principio de legalidad del artículo 11 Constitucional, 11 y 13 de la Ley General de Administración Pública se realizó lo indicado en el oficio SETENA-DT-EAE-046- 2022 (de conocimiento del Concejo) así como lo informado a la Municipalidad en la reunión del 25 de Agosto de 2021 y si no, porque no? Cito lo referido: “De ser la zonificación propuesta para el Plan Regulador de Alajuela diferente a la zonificación propuesta a la que la Nombre3456 le otorgó viabilidad ambiental en la Res. No. 2113-2020-SETENA, se debe cumplir con lo indicado en el por tanto quinto de dicha resolución...”. Adicionalmente si se cumplió con lo establecido en el considerando séptimo de dicha resolución que indica: “Deberá la municipalidad de Alajuela, respetar las condiciones estipuladas en la documentación de la Incorporación de la Variable Ambiental del Plan Regulador de Alajuela, como limitantes, potencialidades y recomendaciones de uso de la tierra, así como también los lineamientos ambientales señalados para cada zona según la zonificación propuesta; todo de conformidad como fue establecido en la versión final de los estudios: Índices de Fragilidad Ambiental, Análisis de Alcance Ambiental y Reglamento de Desarrollo Sostenible, incluidos en el expediente administrativo No. EAE-01-2018-SETENA.” 2- Con respecto a la votación del oficio MA-A-5526-2023 el pasado Martes 19 de Setiembre en el capítulo XI.

INFORMES DE Nombre20749 Y VICE Nombre20749 y lo dicho en el oficio MA-PPCI0782-2A23 que cito a continuación: “Como respuesta a lo solicitado por el Concejo Municipal de Alajuela, me permito por este medio remitir la versión final de la propuesta de nuevo Plan Regulador, la cual contiene los ajustes y actualizaciones recomendados por la Comisión Específica del Plan Regulador (CEPR) y aprobados por el Concejo Municipal.", le ruego me indique en cual sesión y mediante qué acuerdo fueron aprobados por el Concejo dichos ajustes y actualizaciones. Mucho le agradecería tomar en cuenta lo indicado en los oficios mencionados y solicitar a la Nombre3456 si así correspondiera, el respectivo ajuste la viabilidad ambiental de la propuesta del Plan Regulador de previo a la aprobación de la convocatoria a Audiencia Publica en virtud de los cambios profundos que sufrió dicha propuesta entre la fecha del otorgamiento de la viabilidad ambiental y el día de hoy (…)” (copia de la gestión con sello de recibido).

  • 2)A la gestión del recurrente se le asignó el trámite número 0044629-2023 (ver prueba).
  • 3)La gestión del amparado fue conocida por el Concejo Municipal, mediante el artículo N. 24, capítulo VII de la Sesión Ordinaria N.° 42-2023 del 17 de octubre del 2023 y se dispuso lo siguiente: "SE RESUELVE TRASLADAR A LA COMISIÓN ESPECÍFICA DEL PLAN REGULADOR PARA SU DICTAMEN. OBTIENE ONCE VOTOS POSITIVOS. DEFINITIVAMENTE APROBADO". (ver informe) 4) Por oficio MA-SCM-2612-2023 del 23 de octubre de 2023 la Coordinadora del Subproceso de la Secretaria del Concejo Municipal trasladó al amparado el acuerdo indicado en el hecho inmediato anterior (ver oficio aportado al expediente).
  • 5)A la fecha, no se ha dado respuesta a la gestión del amparado (ver informe).

III. SOBRE EL DERECHO DE PETICIÓN Y ACCESO A LA INFORMACIÓN PÚBLICA

El artículo 27 de la Constitución Política consagra el derecho que tiene toda persona, tanto física como jurídica, de acudir a cualquier órgano o entidad pública a peticionar sobre un asunto de su interés, el cual deberá ser resuelto por la Administración en forma oportuna, razonable, congruente, eficaz y en un plazo breve.

Por otra parte, el artículo 30, de la Constitución Política garantiza el libre acceso a los departamentos administrativos con propósitos de información sobre asuntos de interés público, el cual no es irrestricto –pues como todo derecho constitucional posee límites-, ya que quedan a salvo los secretos de Estado. Se procura así una función administrativa transparente, que permita a los sujetos acceder a la información de naturaleza pública que se encuentra en poder de los distintos entes u órganos públicos.

Dentro de este orden de ideas, la jurisprudencia de esta Sala ha establecido con claridad que ambos derechos, exigen a la Administración una acción positiva y clara ante la petición de un ciudadano, respetando los plazos establecidos para dar contestación. Así, si la solución no puede darse por razones de la materia, la administración está obligada a explicar, dentro del plazo exigido por la ley, las razones por las cuales no pueda darse cumplimiento a lo pedido.

IV. CASO CONCRETO

De la relación de hechos demostrados se desprende que por escrito presentado el 29 de setiembre de 2023 el recurrente solicitó al Presidente del Concejo de la Municipalidad de Alajuela la siguiente información: “Le ruego me indique si en cumplimiento del principio de legalidad del artículo 11 Constitucional, 11 y 13 de la Ley General de Administración Pública se realizó lo indicado en el oficio SETENA-DT-EAE-046- 2022 (de conocimiento del Concejo) así como lo informado a la Municipalidad en la reunión del 25 de Agosto de 2021 y si no, porque no? Cito lo referido: “De ser la zonificación propuesta para el Plan Regulador de Alajuela diferente a la zonificación propuesta a la que la Nombre3456 le otorgó viabilidad ambiental en la Res. No. 2113-2020-SETENA, se debe cumplir con lo indicado en el por tanto quinto de dicha resolución...”. Adicionalmente si se cumplió con lo establecido en el considerando séptimo de dicha resolución que indica: “Deberá la municipalidad de Alajuela, respetar las condiciones estipuladas en la documentación de la Incorporación de la Variable Ambiental del Plan Regulador de Alajuela, como limitantes, potencialidades y recomendaciones de uso de la tierra, así como también los lineamientos ambientales señalados para cada zona según la zonificación propuesta; todo de conformidad como fue establecido en la versión final de los estudios: Índices de Fragilidad Ambiental, Análisis de Alcance Ambiental y Reglamento de Desarrollo Sostenible, incluidos en el expediente administrativo No. EAE-01-2018-SETENA.” 2- Con respecto a la votación del oficio MA-A-5526-2023 el pasado Martes 19 de Setiembre en el capítulo XI.

INFORMES DE Nombre20749 Y VICE Nombre20749 y lo dicho en el oficio MA-PPCI0782-2A23 que cito a continuación: “Como respuesta a lo solicitado por el Concejo Municipal de Alajuela, me permito por este medio remitir la versión final de la propuesta de nuevo Plan Regulador, la cual contiene los ajustes y actualizaciones recomendados por la Comisión Específica del Plan Regulador (CEPR) y aprobados por el Concejo Municipal.", le ruego me indique en cual sesión y mediante qué acuerdo fueron aprobados por el Concejo dichos ajustes y actualizaciones. Mucho le agradecería tomar en cuenta lo indicado en los oficios mencionados y solicitar a la Nombre3456 si así correspondiera, el respectivo ajuste la viabilidad ambiental de la propuesta del Plan Regulador de previo a la aprobación de la convocatoria a Audiencia Publica en virtud de los cambios profundos que sufrió dicha propuesta entre la fecha del otorgamiento de la viabilidad ambiental y el día de hoy (…)” (copia de la gestión con sello de recibido).

A esa solicitud se le asignó el trámite 0044629-2023, siendo conocida por el Concejo Municipal, mediante el artículo N. 24, capítulo VII de la Sesión Ordinaria N.° 42-2023 del 17 de octubre de 2023, en el que se dispuso: "SE RESUELVE TRASLADAR A LA COMISIÓN ESPECÍFICA DEL PLAN REGULADOR PARA SU DICTAMEN. OBTIENE ONCE VOTOS POSITIVOS. DEFINITIVAMENTE APROBADO". A la fecha, no se ha dado respuesta al amparado (ver informe).

En el informe, la autoridad accionada indicó: “(…) cuando el trámite se encuentra en la Comisión Específica del Plan Regulador para su Dictamen, y es de suma importancia indicarle a la Sala Constitucional que de acuerdo con el Reglamento interior de Orden Dirección y Debates del Concejo Municipal del cantón Central de Alajuela, específicamente en el capítulo VIII que se refiere a "De las Comisiones de Trabajo" en su artículo 52, refiere el plazo de ley para la resolución de los asuntos puestos en conocimiento de las comisiones que será el inciso 1) el cual indica que: "Las comisiones permanentes y especiales deben resolver todo asunto que sea puesto en su conocimiento dentro de un plazo de 60 días naturales, contando a partir del día siguiente de su recibo en la Secretaria de la Comisión" En virtud de lo anterior, el plazo de 60 días naturales, a partir del recibido del documento, se encuentra vigente y en tiempo para poder brindar respuesta a lo solicitado por el recurrente, tomando en cuenta que el mismo fue recibido en dicha Comisión el 23 de octubre de! año en curso, con el oficio N° MA-SCM-261 1-2023 (adjunto del trámite N° BG-1229-2023 TRÁMITE 44630-2023), plazo que es totalmente justificado que según los cálculos vence hasta el 22 de diciembre de 2023.” (informe).

Conviene analizar el contenido de la gestión de marras para determinar si es amparable lo peticionado y si, como se asegura, se trata de información que requiere como insumo lo dictaminado por la Comisión de Plan Regulador, para lo cual se adjunta el siguiente cuadro:

Adicionalmente si se cumplió con lo establecido en el considerando séptimo de dicha resolución que indica: “Deberá la municipalidad de Alajuela, respetar las condiciones estipuladas en la documentación de la Incorporación de la Variable Ambiental del Plan Regulador de Alajuela, como limitantes, potencialidades y recomendaciones de uso de la tierra, así como también los lineamientos ambientales señalados para cada zona según la zonificación propuesta; todo de conformidad como fue establecido en la versión final de los estudios: Índices de Fragilidad Ambiental, Análisis de Alcance Ambiental y Reglamento de Desarrollo Sostenible, incluidos en el expediente administrativo No. EAE-01-2018-SETENA Petición en relación con el acceso a la información No atendida 3. Con respecto a la votación del oficio MA-A-5526-2023 el pasado Martes 19 de Setiembre en el capítulo XI.

INFORMES DE Nombre20749 Y VICE Nombre20749 y lo dicho en el oficio MA-PPCI0782-2A23 que cito a continuación: “Como respuesta a lo solicitado por el Concejo Municipal de Alajuela, me permito por este medio remitir la versión final de la propuesta de nuevo Plan Regulador, la cual contiene los ajustes y actualizaciones recomendados por la Comisión Específica del Plan Regulador (CEPR) y aprobados por el Concejo Municipal.", le ruego me indique en cual sesión y mediante qué acuerdo fueron aprobados por el Concejo dichos ajustes y actualizaciones.

Petición en relación con el acceso a la información No atendida 4. Mucho le agradecería tomar en cuenta lo indicado en los oficios mencionados y solicitar a la Nombre3456 si así correspondiera, el respectivo ajuste la viabilidad ambiental de la propuesta del Plan Regulador de previo a la aprobación de la convocatoria a Audiencia Publica en virtud de los cambios profundos que sufrió dicha propuesta entre la fecha del otorgamiento de la viabilidad ambiental y el día de hoy (…)” Excitativa No amparable Según se desprende, los primeros aspectos son amparables por los derechos de petición y acceso a la información, los cuales, no han sido debidamente atendidos. En ese sentido, aunque la autoridad recurrida adujo que la gestión fue enviada a la Comisión del Plan Regulador para su atención, en criterio de esta Sala, el traslado a ese órgano es inconsecuente con una solicitud de información como la planteada que no requiere de criterio alguno; derivado de lo anterior, no resulta aplicable el plazo reglamentario citado pues lo pedido no requiere dictamen alguno, sino que es una petición relacionada con solicitud de información. De este modo, en punto a esto el amparo debe ser declarado con lugar.

En cuanto al cuarto aspecto “Mucho le agradecería tomar en cuenta lo indicado en los oficios mencionados y solicitar a la Nombre3456 si así correspondiera, el respectivo ajuste la viabilidad ambiental de la propuesta del Plan Regulador de previo a la aprobación de la convocatoria a Audiencia Publica en virtud de los cambios profundos que sufrió dicha propuesta entre la fecha del otorgamiento de la viabilidad ambiental y el día de hoy (…)”, se trata de excitativa para gestionar ante Nombre3456, lo que no se encuadra dentro del derecho de petición propiamente, por lo que el recurso debe desestimarse en cuanto a este extremo.

En conclusión: se acredita la violación de los derechos fundamentales de la parte recurrente por la falta de atención de los extremos identificados en el cuadro con 1, 2, 3, por lo que el asunto ser declarado con lugar, mientras que, respecto al punto 4 antes explicado debe ser desestimado al no estar su contendido amparado por el derecho de petición y acceso a la información.

V. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara parcialmente con lugar el recurso. Se ordena a Randall Barquero Piedra, en su condición de Presidente del Concejo de la Municipalidad de Alajuela, o a quien ocupe ese cargo, que en el plazo de diez días contado a partir de la notificación de esta sentencia, se brinde respuesta sobre los extremos identificados con los números 1, 2 y 3 de la gestión formulada por la parte recurrente. Lo anterior, bajo el apercibimiento que, de conformidad con lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Alajuela al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Se declara sin lugar el recurso respecto de la excitativa a la Nombre3456 contendida en la solicitud de marras. Notifíquese.- Nombre152 C.
