Subsequently, in official communication MS-DVS-PMICV-0234-2023 of September 18, 2023, the Health Surveillance Directorate communicated to the Director of the Health Surveillance Directorate and to the Regional Director of the Central North Health Rector's Office, Ministry of Health: “We hereby inform you regarding the visit made to the Inbioparque on September 8 of this year, on this day Rose Mary Hidalgo Rios and José Manuel Gutiérrez Alvarado from the PMICV-DVS Central Level, together with official José Mondragón González from PMICV-Heredia, appeared at said location, officials Diana Víquez Zamora and Pamela Garita Ramírez from the Environmental Management section of the Santo Domingo Health Rector's Area also appeared, where we conducted a tour of the entire park, in which we were accompanied by an official from the Inbioparque, during said tour we encountered three lagoons, a puddle, a black plastic, several piñuela-type plants whose axils retain small amounts of water, which are potential breeding sites for Aedes aegypti, and two tires, in all of these different types of larvae were found, and they were treated with biological larvicide Bacillus thuringiensis israelensis (BTI).
Likewise, official communication MS-DVS-PMICV-0233-2023 is attached, detailing the analysis and results of the larval samples. Recommendations: In the lagoons, keep the edges clean to prevent larvae from sheltering in the vegetation and introduce larvivorous fish, regarding other native species present, in the case of the puddle, create a small channel so that water does not stagnate, eliminate the plastic and seek a more adequate mechanism to protect institutional assets from inclement weather, regarding piñuela-type plants, they can be drained or BTI can be used, and as for the tires, drill holes in them or fill them with soil or sand”. Furthermore, in official communication MS-DVS-PMICV-0238-2023 of October 23, 2023, the Health Surveillance Directorate communicated to the Central North Regional Health Rector's Office: “We hereby inform you regarding the follow-up conducted at the Inbioparque on October 3, 2023, on this day we appeared at said location where we again conducted a tour of the entire park, in which we were accompanied by official Mesén Rodríguez, an employee of the Inbioparque, during said tour we were able to observe that some of the breeding sites found on the first visit had already been eliminated, except for the piñuela plants and the lagoons, in the case of the lagoons, a characterization was carried out, which verified that the larval density did decrease, meaning larvae were not found in some of them, however, larvae were found in the lagoon called los lirios, as well as in the piñuela-type plants, which retain small amounts of water; it is worth mentioning that the lagoons were again treated with biological larvicide bacillus thuringiensis israelensis (BTI).
Recommendations: Schedule a new visit to apply biological larvicide bacillus thuringiensis israelensis (BTI) once more in the lagoons, and it is also recommended to spray the piñuela-type plants using a backpack sprayer with the same biological larvicide, with the aim of eliminating the larvae found in them.” It should be noted that, as of the date of the report rendered by the respondent authorities and the evidence in the record, it is ruled out that the sanitary problems existing at the Inbioparque facilities have been resolved in a comprehensive and definitive manner, or that the fumigation in question has been carried out, which is why this appeal must be granted, with the consequences indicated in the operative part. Amparo appeal filed by [Name62 001], identity card number [ID62 ], against the NATIONAL SYSTEM OF CONSERVATION AREAS and the MINISTRY OF HEALTH.
WHEREAS:
Drafted by Magistrate Cruz Castro; and,
Considering:
I.I.- SUBJECT OF THE APPEAL. The appellant indicates that she works at the Executive Secretariat of the National System of Conservation Areas, whose offices were installed in the Ecological Park -Inbioparque-, which does not have optimal maintenance; the lagoon is abandoned, which causes the proliferation of mosquito breeding sites, insects that constantly bite the officials who work on-site, exposing them to diseases such as dengue, and as a palliative measure, insecticides were provided so that the officials themselves could fumigate; however, this does not prevent people from being bitten when they remain in certain outdoor areas. She asserts that the Ministry of Health is aware of the situation, and in fact, visits and larval analyses have been conducted through official communications No. MS-DVS-PMICV-0233-2023 and No. MS-DVS-PMICV-0234-2023 of September 13 and 18, 2023, respectively. Despite the foregoing, no measures have been taken nor instructions issued aimed at protecting the integrity of the officials of the Executive Secretariat of the National System of Conservation Areas.
Relevant to resolving this amparo appeal, the following are established as proven:

From the report rendered under oath by the respondent authorities, with the consequences, including criminal ones, provided for in numeral 44 of the Constitutional Jurisdiction Law, an infringement of the fundamental rights of the appellant is established, based on the considerations set forth below.
In that regard, it is established that in official letter MS-DVS-PMICV-0233-2023 dated September 13, 2023, official José Manuel Gutiérrez Alvarado of Vector Control, Central Level, Health Surveillance Directorate, communicated to the Health Surveillance Director and to the Regional Director of the Central North Health Rectorate the results of the larval sample analysis in the Inbioparque: “:¨Diagnosis sample. Sample # 1 positive for Aedes aegypti, breeding site = tire (Llanta), sector 4 Recreation Area Sample # 2 positive for Culex quinquesfasciatus, breeding site = puddle (Charco), sector 4, by the Fungus. Sample # 3 positive for Culex coronator, breeding site = Lagoon 2 the lilies (Laguna 2 los lirios). Sample # 4 positive for Aedes albopictus, breeding site = tire (Llanta) sector 4, Human Resources. Sample # 5 positive for Nombre9524 , breeding site = Lagoon 3. Sample # 6 positive for Nombre9524 , breeding site = Lagoon 1 the turtles (Laguna 1 las tortugas).

On that day, Rose Mary Hidalgo Rios and José Manuel Gutiérrez Alvarado from the PMICV-DVS Central Level, together with official José Mondragón González from the PMICV-Heredia, appeared at said location.
Officials Diana Víquez Zamora and Pamela Garita Ramírez from the Environmental Management section of the Santo Domingo Health Rectorate Area also appeared, where we conducted a walk-through of the entire park, in which we were accompanied by an official from the Inbioparque. During said walk-through, we found three lagoons, a puddle, a black plastic sheet, several piñuela-type plants (plantas tipo piñuelas) whose axils retain small amounts of water, which are potential breeding sites for Aedes aegypti, and two tires; in all of these, different types of larvae were found. They were all treated with the biological larvicide Bacillus thuringiensis israelensis (BTI). Likewise, official letter MS-DVS-PMICV-0233-2023 is attached, detailing the analysis and results of the larval samples. Recommendations: In the lagoons, keep the edges clean to prevent larvae from sheltering in the vegetation and introduce larvivorous fish, over other present native species; in the case of the puddle, make a small channel so that water does not stagnate; eliminate the plastic and seek a more suitable mechanism to protect the institutional asset from inclement weather; regarding the piñuela-type plants, they can be drained or BTI can be used; and as for the tires, drill holes in them or fill them with soil or sand.” Furthermore, in official letter MS-DVS-PMICV-0238-2023 dated October 23, 2023, the Health Surveillance Directorate communicated to the Regional Directorate of the Central North Health Rectorate: “By this means, I inform you regarding the follow-up conducted at the Inbioparque on October 3, 2023.
On that day, we appeared at said location where we again conducted a walk-through of the entire park, in which we were accompanied by official Mesén Rodríguez, an official from the Inbioparque. During said walk-through, we were able to observe that some of the breeding sites found on the first visit had already been eliminated, except for the piñuela plants and the lagoons. In the case of the lagoons, a characterization was carried out, which verified that the larval density did decrease; that is, no larvae were found in some of them. However, in the lagoon called the lilies (los lirios), larvae were indeed found, as well as in the piñuela-type plants, which retain small amounts of water. It should be mentioned that the lagoons were treated again with the biological larvicide Bacillus thuringiensis israelensis (BTI). Recommendations: Schedule another visit to apply the biological larvicide Bacillus thuringiensis israelensis (BTI) in the lagoons once more.
It is also recommended to spray the piñuela-type plants using a motorized backpack sprayer (moto mochila) with the same biological larvicide, with the aim of eliminating the larvae found in them.” Note that as of the date of the report rendered by the respondent authorities and the evidence contained in the case file, it is ruled out that the sanitation (sanitarios) problems existing in the Inbioparque facilities have been resolved in an integral and definitive manner and that the fumigation in question has been carried out, which is why this appeal must be granted, with the consequences indicated in the operative part.
The parties are forewarned that if they have provided any physical document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or device produced by new technologies, these must be withdrawn from the court office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, any material not withdrawn within this period will be destroyed, in accordance with the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the full court in session number 27-11 of August 22, 2011, article XXVI and published in the Judicial Bulletin number 19 of January 26, 2012, as well as the agreement approved by the Superior Council of the Judiciary, in session number 43-12 held on May 3, 2012, article LXXXI.
POR TANTO:
The appeal is granted. David Chavarría Morales, in his capacity as Executive Director of the National System of Conservation Areas, Karina Garita Montoya, in her capacity as Director of the Regional Directorate of the Central North Health Rectorate, and Roberto Castro Córdoba, in his capacity as Acting Director of Health Surveillance, or whoever occupies those positions, are ordered to carry out the necessary actions within the scope of their respective competencies so that, within a period of TWO MONTHS, counted from the notification of this judgment, the sanitation (sanitarios) problems present in the Inbioparque are resolved definitively. It is warned that, in accordance with the provisions of article 71 of the Constitutional Jurisdiction Law, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on anyone who receives an order that must be complied with or enforced, issued in an amparo appeal, and does not comply with it or enforce it, provided the offense is not more severely punished. The State and the National System of Conservation Areas are ordered to pay the costs, damages, and losses caused by the acts serving as the basis for this declaration, which shall be liquidated in the execution of the judgment in administrative contentious proceedings. Posteriormente, en oficio MS-DVS-PMICV-0234-2023 18 de setiembre del 2023, la Dirección de Vigilancia de la Salud comunicó al Director de la Dirección Vigilancia de la Salud y a la Directora Regional Rectoría de la Salud Central Norte Ministerio de Salud: “Por este medio les informamos referente a la visita realizada al Inbioparque el pasado 8 de setiembre del presente año, este día nos apersonamos a dicho lugar Rose Mary Hidalgo Rios y José Manuel Gutiérrez Alvarado del PMICV-DVS Nivel Central en conjunto con el funcionario José Mondragón González del PMICV-Heredia, también se apersonaron las funcionarias Diana Víquez Zamora y Pamela Garita Ramírez de la parte de Gestión Ambiental del Área Rectora de Salud Santo Domingo, donde realizamos un recorrido en todo el parque, en el cual fuimos acompañados por un funcionario del Inbioparque, en dicho recorrido nos encontramos con tres lagunas, un charco, un plástico negro, varias plantas estilo piñuelas y en sus axilas retienen pequeñas cantidades de agua las cuales son criaderos potenciales para el Aedes aegypti y dos llantas, en todos estos se encontraron diferentes tipos de larvas, los mismos fueron tratados con larvicida biológico Bacillus thuringiensis israelensis (BTI).
Así mismo de adjunta oficio MS-DVS-PMICV-0233-2023, en el cual se detalla el análisis y resultados de las muestras larvarias. Recomendaciones: En las lagunas, mantener limpios en el sectores de las orillas, esto para evitar que las larvas se refugien en la vegetación e introducir peces larvívoros, sobre otras especies nativas presentes, en el caso del charco realizar un pequeño canal de manera que no se estanque el agua, el plástico eliminarlo y buscar un mecanismo más adecuado para proteger de las inclemencias del tiempo el activo institucional, referente a las plantas tipo piñuela se pueden drenar o bien utilizar BTI, y en cuanto a las llantas, realizar perforaciones a estas o bien rellenarlas con tierra o arena”. Además, en oficio MS-DVS-PMICV-0238-2023 del 23 de octubre de 2023 la Dirección de Vigilancia de la Salud comunicó a la Dirección Regional Rectoría de la Salud Central Norte “Por este medio les informó referente al seguimiento realizado al Inbioparque el 3 de octubre de 2023, este día nos apersonamos a dicho lugar donde nuevamente realizamos un recorrido en todo el parque, en el cual fuimos acompañados por el funcionario Mesén Rodríguez, funcionario del Inbioparque, en dicho recorrido logramos observar, que algunos de los criaderos encontrados en la primera visita ya fueron eliminados, exceptos las plantas piñuelas y las lagunas, en el caso de las lagunas se realizó caracterización, con la cual se verificó que si bajo la densidad larvaria, es decir, no se encontraron larvas en algunas de ellas, sin embargo, en la laguna llamada los lirios si se encontraron larvas, así también en las plantas tipo piñuelas, las cuales retienen pequeñas cantidades de agua, cabe mencionar que en cuanto a las lagunas nuevamente se trataron con larvicida biológico bacillus thuringiensis israelensis (BTI).
Recomendaciones: Programar nuevamente una visita para realizar una vez más la aplicación de larvidad biológico bacillus thuringiensis israelensis (BTI), en las lagunas, así también se recomienda realizar un rociado con moto mochila sobre las plantas tipo piñuela, utilizando el mismo larvicida biológico, esto con el objetivo de eliminar las larvas que se encuentran en ellas”. Nótese que a la fecha del informe rendido por las autoridades recurridas y de las pruebas que constan en autos se descarta que los problemas sanitarios que existen en las instalaciones del Inbioparque haya sido solucionado de manera integral y definitiva y que la fumigación en cuestión se haya realizado, motivo por el cual el presente recurso debe ser estimado, con las consecuencias que se indican en la parte dispositiva. Recurso de amparo interpuesto por [Nombre62 001], cédula de identidad número [CED62 ], contra el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN y el MINISTERIO DE SALUD.
RESULTANDO:
Redacta el Magistrado Cruz Castro; y,
Considerando:
I.I.- OBJETO DEL RECURSO. La recurrente indica que labora en la Secretaría Ejecutiva del Sistema Nacional de Áreas de Conservación, cuyas oficinas fueron instaladas en el Parque Ecológico -Inbioparque-, el cual no tiene un mantenimiento óptimo, la laguna se encuentra abandonada, lo que provoca la proliferación de criaderos de zancudos, insectos que constantemente pican a los funcionarios que laboran de manera presencial, lo que los expone a enfermedades como dengue, por lo que de manera paliativa entregaron insecticidas para que los mismos funcionarios fumiguen; sin embargo, esto no impide que las personas sean picadas cuando permanecen en ciertas zonas que se encuentran al aire libre. Asegura que el Ministerio de Salud conoce la situación, de hecho han efectuado visitas y análisis larvarios por oficios No. MS-DVS-PMICV-0233-2023 y No. MS-DVS-PMICV-0234-2023 de 13 y 18 de setiembre de 2023, respectivamente. A pesar de lo anterior, no se han tomado medidas ni girado instrucciones destinadas a proteger la integridad de los funcionarios de la Secretaría Ejecutiva del Sistema Nacional de Áreas de Conservación.
De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:

Recomendaciones: En las lagunas, mantener limpios en el sectores de las orillas, esto para evitar que las larvas se refugien en la vegetación e introducir peces carnívoros, sobre otras especies nativas presentes, en el caso del charco realizar un pequeño canal de manera que no se estanque el agua, el plástico eliminarlo y buscar un mecanismo más adecuado para proteger de las inclemencias del tiempo el activo institucional, referente a las plantas tipo piñuela se pueden drenar o bien utilizar BTI, y en cuanto a las llantas, realizar perforaciones a estas o bien rellenarlas con tierra o arena” (informe de las autoridades recurridas).
Recomendaciones: Programar nuevamente una visita para realizar una vez más la aplicación de larvidad biológico bacillus thuringiensis israelensis (BTI), en las lagunas, así también se recomienda realizar un rociado con moto mochila sobre las plantas tipo piñuela, utilizando el mismo larvicida biológico, esto con el objetivo de eliminar las larvas que se encuentran en ellas” (informe de las autoridades recurridas).
Del informe rendido bajo juramento por las autoridades recurridas, con las consecuencias incluso penales que prevé el numeral 44 de la Ley de la Jurisdicción Constitucional se acredita una infracción a los derechos fundamentales de la parte recurrente, con fundamento en las consideraciones que a continuación se exponen. Al respecto, se acredita que en el oficio MS-DVS-PMICV-0233-2023 del 13 de setiembre del 2023, el funcionario José Manuel Gutiérrez Alvarado de Control de Vectores Nivel Central Direccion Vigilancia de la Salud comunicó al Director de Vigilancia de la Salud y a la Directora Regional Rectoría de la Salud Central Norte los resultados de análisis de muestras larvarias en el Inbioparque: “:¨Diagnostico muestra. Muestra # 1 positiva por Aedes aegypti, criadero = Llanta, sector 4 Área de recreo Muestra # 2 positiva por Culex quinquesfasciatus, criadero = Charco, sector 4 , por el Hongo.
Muestra # 3 positiva por Culex coronator, criadero = Laguna 2 los lirios. Muestra # 4 positiva por Aedes albopictus, criadero = Llanta sector 4, Recursos Humanos. Muestra # 5 positiva por Nombre9524 , criadero = Laguna 3. Muestra # 6 positiva por Nombre9524 , criadero = Laguna 1 las tortugas. Muestra # 7 positiva por Nombre9524 , criadero = Laguna 2 los Lirios Muestra # 8 positiva por Nombre9525 , criadero = Plástico Negro carreta de lancha Muestra # 9 positiva por Nombre9525 , criadero = Laguna INBIOparque ecológico”. Posteriormente, en oficio MS-DVS-PMICV-0234-2023 18 de setiembre del 2023, la Dirección de Vigilancia de la Salud comunicó al Director de la Dirección Vigilancia de la Salud y a la Directora Regional Rectoría de la Salud Central Norte Ministerio de Salud: “Por este medio les informamos referente a la visita realizada al Inbioparque el pasado 8 de setiembre del presente año, este día nos apersonamos a dicho lugar Rose Mary Hidalgo Rios y José Manuel Gutiérrez Alvarado del PMICV-DVS Nivel Central en conjunto con el funcionario José Mondragón González del PMICV-Heredia, también se apersonaron las funcionarias Diana Víquez Zamora y Pamela Garita Ramírez de la parte de Gestión Ambiental del Área Rectora de Salud Santo Domingo, donde realizamos un recorrido en todo el parque, en el cual fuimos acompañados por un funcionario del Inbioparque, en dicho recorrido nos encontramos con tres lagunas, un charco, un plástico negro, varias plantas estilo piñuelas y en sus axilas retienen pequeñas cantidades de agua las cuales son criaderos potenciales para el Aedes aegypti y dos llantas, en todos estos se encontraron diferentes tipos de larvas, los mismos fueron tratados con larvicida biológico Bacillus thuringiensis israelensis (BTI).
Así mismo de adjunta oficio MS-DVS-PMICV-0233-2023, en el cual se detalla el análisis y resultados de las muestras larvarias. Recomendaciones: En las lagunas, mantener limpios en el sectores de las orillas, esto para evitar que las larvas se refugien en la vegetación e introducir peces larvívoros, sobre otras especies nativas presentes, en el caso del charco realizar un pequeño canal de manera que no se estanque el agua, el plástico eliminarlo y buscar un mecanismo más adecuado para proteger de las inclemencias del tiempo el activo institucional, referente a las plantas tipo piñuela se pueden drenar o bien utilizar BTI, y en cuanto a las llantas, realizar perforaciones a estas o bien rellenarlas con tierra o arena”. Además, en oficio MS-DVS-PMICV-0238-2023 del 23 de octubre de 2023 la Dirección de Vigilancia de la Salud comunicó a la Dirección Regional Rectoría de la Salud Central Norte “Por este medio les informó referente al seguimiento realizado al Inbioparque el 3 de octubre de 2023, este día nos apersonamos a dicho lugar donde nuevamente realizamos un recorrido en todo el parque, en el cual fuimos acompañados por el funcionario Mesén Rodríguez, funcionario del Inbioparque, en dicho recorrido logramos observar, que algunos de los criaderos encontrados en la primera visita ya fueron eliminados, exceptos las plantas piñuelas y las lagunas, en el caso de las lagunas se realizó caracterización, con la cual se verificó que si bajo la densidad larvaria, es decir, no se encontraron larvas en algunas de ellas, sin embargo, en la laguna llamada los lirios si se encontraron larvas, así también en las plantas tipo piñuelas, las cuales retienen pequeñas cantidades de agua, cabe mencionar que en cuanto a las lagunas nuevamente se trataron con larvicida biológico bacillus thuringiensis israelensis (BTI).
Recomendaciones: Programar nuevamente una visita para realizar una vez más la aplicación de larvidad biológico bacillus thuringiensis israelensis (BTI), en las lagunas, así también se recomienda realizar un rociado con moto mochila sobre las plantas tipo piñuela, utilizando el mismo larvicida biológico, esto con el objetivo de eliminar las larvas que se encuentran en ellas”. Nótese que a la fecha del informe rendido por las autoridades recurridas y de las pruebas que constan en autos se descarta que los problemas sanitarios que existen en las instalaciones del Inbioparque haya sido solucionado de manera integral y definitiva y que la fumigación en cuestión se haya realizado, motivo por el cual el presente recurso debe ser estimado, con las consecuencias que se indican en la parte dispositiva.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. Se le ordena a David Chavarría Morales, en su condición de Director Ejecutivo del Sistema Nacional de Áreas de Conservación, Karina Garita Montoya, en su condición de Directora de la Dirección Regional de Rectoría de la Salud Central Norte y a Roberto Castro Córdoba, en su condición de Director a. i. de Vigilancia de la Salud, o a quienes ocupen esos cargos, que realicen las gestiones necesarias dentro del ámbito de sus respectivas competencias para que, en el plazo de DOS MESES, contados. a partir de la notificación de esta sentencia, se solucione de manera definitiva los problemas sanitarios presentes en el Inbioparque. Se advierte que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y al Sistema Nacional de Áreas de Conservación al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
