Application for constitutional relief (recurso de amparo) filed by [Nombre 001], identity card number [CED62 ], on behalf of [Nombre 002], identity card number [CED104 ], against the MUNICIPALIDAD DE CARTAGO and the MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES.

Findings of Fact:

  1. 1In a written submission filed with the Clerk’s Office of this Chamber at 13:42 on 30 de agosto del 2023, the petitioner filed an application for constitutional relief against the MUNICIPALIDAD DE CARTAGO and the MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES. He states that approximately 50 years ago, his parents acquired a property located in the province of Cartago, cantón Central, distrito Occidental, on the west side of the Dirección1227 sports field, where they live and keep cattle. He adds that the property borders to the west on a 20-meter-wide street and the Reserva Nacional los Diques, a reserve that has been illegally occupied by Costa Rican and foreign nationals for approximately 6 years. He alleges that the fence around his property was torn down by the occupants so that they could begin the illegal construction work, and that they also blocked the access to which they are entitled on the west side of the property.He states that, since 2018, he has repeatedly requested the intervention of the Departamento de Urbanismo and the Alcaldía, both part of the Municipalidad de Cartago, which have shown complete tolerance of and inaction regarding the situation, claiming that it falls outside their jurisdiction and instead within that of the Ministerio de Obras Públicas y Transportes—which he disputes, since they are responsible for building and urban-development oversight in the canton. He asserts that this amounts to a clear breach of duty and municipal inaction, particularly because the property involved is public-domain property (bien demanial)—the Reserva Nacional Los Diques—as well as the private property of taxpaying individuals. He claims that the dwellings are constructed illegally during both the day and night and that their occupants also receive electricity and drinking-water services illegally—through a 10.000-liter tank that was installed for them.He argues that the situation described causes both him and his mother—the 84-year-old older adult protected by this proceeding—terrible psychological, emotional, and financial harm, because sewage, stormwater, and tons of garbage enter their property, and because they are subjected to insults, objects being thrown, harm and mistreatment of their animals, damage to the property, theft, and intrusions by unknown persons. He argues that when they call the Policía Municipal, they are told that the matter falls within the jurisdiction of the Departamento de Urbanismo, while the latter tells them that nothing can be done because the structures have already been built; however, he believes that those illegal structures should be demolished. Likewise, when they call the Fuerza Pública, they are told that the matter is outside its jurisdiction. In addition, regarding the requirement and obligation to build sidewalks at residences, he alleges that he was notified on 4 de diciembre de 2015 that he was required to build the sidewalk, which was assessed and valued at 1.241.876,09 colones; however, the adjoining neighbor was not notified until the petitioner himself insisted—in pursuit of equal treatment—and, moreover, the neighbor was charged a lower amount. Based on the foregoing, he requests the intervention of this Constitutional Court.
  2. 2By an order issued at 17:56 on 31 de agosto del 2023, the present application for constitutional relief was admitted for processing, and reports were requested from the mayor and the director of the Departamento de Urbanismo, both of the Municipalidad de Cartago, as well as from the director of the Departamento de Previsión Vial of the Ministerio de Obras Públicas y Transportes (see electronic record).
  3. 3Mario Redondo Poveda, in his capacity as Alcalde, and Juan Carlos Guzmán Víquez, Director de Urbanismo Municipal, both of the Municipalidad de Cartago, report under oath as follows: “In view of the aforementioned order concerning the application for constitutional relief filed under expediente 23-021047-0007-CO by Mr. [Nombre 001], identity card CED7496, on behalf of [Nombre 002], identity card CED7497, against the Municipalidad de Cartago and the Ministerio de Obras Públicas y Transportes, regarding the facts alleged by the petitioner (sic). As to the first issue, through the case file cited below, the SALA CONSTITUCIONAL recognizes the position that MOPT is the agency with jurisdiction to maintain the dikes.

Based on the foregoing, and because the application for constitutional relief seeks to report the existence of construction work and circumstances reflecting a lack of maintenance of the dike, we hereby request that this application for constitutional relief be denied. Second, according to the Registry, Mr. [Nombre 001] owns no property registered in his name, as demonstrated by the Registry records:

Accordingly, the petitioners cannot argue that the authorities have shown complete tolerance of and inaction regarding the situation, because they have no property registered in their names that could be adversely affected. Without prejudice to the foregoing, the reported facts are specifically directed toward alleging a violation of their constitutional rights, in this case with respect to property that they do not own and inequalities in relation to other owners, even though, it bears repeating, they are not the owners of properties (fundos) affected by the reported facts. Regarding the claim that residents of that sector illegally receive (…) and drinking water through a 10.000-liter tank, the Director del Eje del Acueducto Municipal stated by email dated 06 de setiembre de 2023: ‘Good day, Don Nombre6449. In this regard, I can inform you that this water-service department has no record that the installation of any drinking-water storage infrastructure adjoining the property of the person who filed the application for constitutional relief has been authorized.

You are also advised that this sector, which contains a human settlement known as dique, has been supplied from a humanitarian public standpipe (paja pública) for approximately 15 years.’ Furthermore, in Resolution Nº 01739 –2012 of 10 de febrero del 2012 at 09:05, expediente judicial 12-000685-0007-CO, this Honorable Chamber ruled: ‘III.- Merits. With respect to access to drinking water as a fundamental right, among other decisions, in judgment #2007-998 issued at 11:15 on 26 de enero del 2007, the Chamber explained its implications as follows: The Chamber recognizes, as part of Constitutional Law, a fundamental right to drinking water derived from the fundamental rights to health, life, a healthy environment, food, and adequate housing, among others, as has also been recognized in international human-rights instruments applicable in Costa Rica: (…). “Article 11. Right to a healthy environment. 1.

Everyone has the right to live in a healthy environment and to have access to basic public services.” (...). Nor may it be inferred from this that the fundamental right to public services is not specifically enforceable; on the contrary, when the State may reasonably be required to provide them, rights holders may demand them, and public administrations—or, where applicable, private parties providing such services in their place—may not take refuge in alleged resource shortages, the age-old public excuse used to justify failures to fulfill their mandates. Our Constitución Política implicitly enshrines the fundamental right of the public to the sound and efficient operation of public services—that is, to their provision according to high quality standards—with the necessary corresponding obligation of public administrations to provide them continuously, regularly, promptly, effectively, and efficiently.

IV.- Likewise, it has accepted the installation of public drinking-water sources in human settlements that do not meet the minimum legal conditions for habitability, without the aforementioned fundamental right giving rise to an obligation to install individual services for the residents of the area, precisely because minimum urban-development conditions are lacking.’ In view of the foregoing, the application for constitutional relief being pursued is reckless and disproportionate, first because constitutional case law establishes which entity is responsible for maintaining the Río Reventado dikes and, second, because the provision of public services is likewise protected as a constitutional right. Finally, as to encroachments on private property, the Municipality lacks jurisdiction to resolve boundary disputes; we therefore respectfully request that this Judicial Authority summarily dismiss the application as reckless and disproportionate.” They request that the application be denied.

  1. 4According to a certification signed by the Judicial Assistant and the Secretary of the Court, there was no indication that, between cuatro al dieciocho de septiembre del 2023, the DIRECTOR DEL DEPARTAMENTO DE PREVISIÓN VIAL DEL MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES filed any written submission or document for purposes of rendering the report requested in the order issued at diecisiete horas y cincuenta y seis minutos del treinta y uno de agosto del 2023 (see electronic record).
  2. 5By an order issued at 18:40 on 24 de setiembre del 2023, the reporting justice expanded the scope of the proceeding and requested a report from the Ministro de Obras Públicas y Transportes (see electronic record).
  3. 6Luis Esteban Amador Jiménez, in his capacity as Ministro de Obras Públicas y Transportes, reports under oath (see electronic record) as follows: “On 28 de setiembre de 2023, Engineer Eyden Ajoy Arnáez, Jefe del Departamento de Previsión Vial, forwarded to the Dirección de Asesoría Jurídica a copy of the actions taken by the department he represents. Among the matters to be considered, we attach the response submitted to Magistrado Fernando Cruz Castro by Engineer Luis Diego Rodríguez Chaves in his capacity as Coordinador del Departamento de Previsión Vial. It should be noted that, in that report, Engineer Rodríguez Chaves stated the following to the SALA CONSTITUCIONAL:

As can be seen from the documentation submitted to the Dirección de Asesoría Jurídica of the Institution, the Departamento de Previsión Vial responded in a timely and proper manner on Wednesday, 06 de setiembre del año en curso (a copy of the email is attached). Nevertheless, in the case at hand, it should be emphasized that, if the land occupied by third parties belonged to the Ministerio de Obras Públicas y Transportes, the entity with jurisdiction to verify encroachments upon the right-of-way (derecho de vía) would be the Departamento de Inspección Vial y Demoliciones (…) However, after reviewing the complaint filed by Ms. [Nombre 002], there is no evidence of any encroachment upon the right-of-way; rather, she states before the Sala Constitucional that illegal structures exist in Reserva Nacional Los Diques, located in Provincia de Cartago. In view of the foregoing, it is clear and evident that we could not have violated the petitioner’s fundamental rights in any way, because construction permits and all matters relating to inspections concerning sanitation, sewage, garbage, pollution, and animal abuse are not the responsibility of the Ministerio de Obras Públicas y Transportes.

On the contrary, those issues fall within the jurisdiction of the municipal authority, which, from the time it became aware of the alleged encroachments in the canton, as well as the irregularities that continue to exist in connection with the structures reported by Ms. [Nombre 002], should have acted in accordance with its powers, given the existence of a biological corridor (Corredor Biológico) or national reserve (Reserva Nacional).” He requests that the application be dismissed.

  1. 7Luis Diego Rodríguez Chaves, in his capacity as Coordinator of the Departamento de Previsión Vial of the División de Obras Públicas of MOPT, states under oath (see electronic record) as follows: “Executive decree (decreto ejecutivo) N° 22334 MOPT - MVAH, Article 5, provides: ‘The Dirección General de Viabilidad of the Ministerio de Obras Públicas y Transportes, through the competent departments, shall be responsible for issuing the applicable building setback alignment (alineamiento), in strict compliance with the provisions of this decree.’ Accordingly, this department alone has among its functions the issuance of the applicable building setback alignment for Los Diques, which is a requirement imposed by the municipalities for a construction permit. As stated in Article 4, a. sector N° 1: ‘…The Ministerio de Recursos Naturales, Energía y Minas shall regulate the granting of concessions for and the exploitation of quarries in this sector, and the public institutions of the region, particularly the Municipalidad de Cartago, shall exercise the relevant oversight. In any proceeding, the Comisión Nacional de Emergencia must first be given an opportunity to be heard so that it may issue the relevant opinion.’” He requests that the application be dismissed.
  2. 8By decision issued at 14:12 hours on 08 de octubre del 2023, the reporting justice requested, as evidence to assist in adjudication (prueba para mejor resolver), that Mario Redondo Poveda, in his capacity as Mayor, and Juan Carlos Guzmán Víquez, Director de Urbanismo Municipal, both of the Municipalidad de Cartago, conduct an on-site inspection (inspección in situ) and report the following: 1.) Whether there is any blockage at the western entrance to property number 3045946-000; 2.) Whether the human settlement known as dique causes problems involving sewage, stormwater, and/or pollution from improper waste management on property number 3045946- 000 (see electronic record).
  3. 9Mario Redondo Poveda, in his capacity as Mayor, and Juan Carlos Guzmán Víquez, Director de Urbanismo Municipal, both of the Municipalidad de Cartago, state under oath as follows: “Regarding the request that an on-site inspection be conducted and that the following be reported to this Chamber: Is there any blockage at the western entrance to property number 3045946-000? The on-site inspection was conducted on 11 de octubre de 2023 at 13:53 hours in the presence of Arq. Juan Carlos Guzman Viquez, Director de Urbanismo Municipal. At the site, the inspection was attended by Mr. Wagner [Nombre 001], identity card CED7496, in his capacity as Nombre9362 (he does not produce any supporting document). As to item 1, the area was inspected up to what appeared to be the property boundaries (linderos), but the boundaries could not be determined because there are no physical markers demarcating the property.As to the apparent blockage, none exists, because the property in question adjoins the base of the dike. This is established by the property and cadastral records, as reflected in cadastral plan (plano de catastro) C-299965-1996 and the attached property-registry report, which show that the property under examination neither adjoins nor has any type of access. 2.) Does the human settlement known as dique cause problems involving sewage, stormwater, and/or pollution from improper waste management on property number 3045946- 000? Without prejudice to the fact that, with due respect, this Chamber is advised that the request exceeds municipal authority because determining whether pollution or problems involving sewage, stormwater, or improper waste management exist is a matter for the Ministerio de Salud—rectius: Área Rectora de Salud de Cartago—as it is a public-health matter pursuant to Articles 1, 275, 285, 287, 288, 292 and 313.8 b) of the Ley General de Salud, the following applies: ‘ARTICLE 1.- The health of the population is a matter of public interest protected by the State.ARTICLE 275.- All natural or legal persons are prohibited from directly or indirectly polluting surface water, groundwater, and territorial maritime waters through drainage or through the intentional or negligent discharge or storage of liquid, solid, or gaseous waste or refuse, whether radioactive or nonradioactive, sewage, or substances of any kind that, by altering the water’s physical, chemical, and biological characteristics, make it hazardous to the health of humans or terrestrial and aquatic fauna, or unfit for domestic, agricultural, industrial, or recreational use. ARTICLE 285.- Excreta, sewage, wastewater, and stormwater must be disposed of properly and hygienically in order to prevent contamination of the soil and natural water sources intended for human use and consumption, the formation of breeding grounds for disease vectors, and air pollution through conditions that compromise its purity or quality.ARTICLE 287.- Every natural or legal person who owns dwellings, establishments, or buildings in which people conduct their activities shall be responsible for ensuring that such properties have a system for the disposal of excreta, sewage, and wastewater approved by the Ministry, and users of dwellings, establishments, or buildings shall be required to maintain that system in good operating condition. ARTICLE 288.- Every owner is required to connect the system for disposing of excreta, sewage, and wastewater from the owner’s property to the sanitary sewer system in places where such a system is operating, except in those cases recognized as proper exceptions by the applicable regulations. ARTICLE 292.- The discharge of sewage, wastewater, and industrial waste into the storm sewer system is prohibited in all cases. The Ministry is hereby empowered to restrict, regulate, or prohibit the disposal of non-biodegradable synthetic products through systems for collecting excreta, sewage, and wastewater.ARTICLE 313.- Every individual, single-family, or multifamily dwelling must meet the following sanitary requirements: b) Adequate systems for the disposal of excreta, sewage, wastewater, and stormwater approved by the health authority.’ As to the alleged handling of graywater (aguas jabonosas), sewage, and stormwater, only one graywater outlet from a dwelling was observed. As to the alleged handling of stormwater, 3 dwellings were observed that do not have gutters and downspouts capable of channeling the water to a suitable discharge point. In view of the foregoing, Your Judicial Authority is respectfully requested to dismiss in its entirety the application for amparo relief (recurso de amparo) as unfounded, frivolous, and disproportionate, since the Municipality lacks jurisdiction to resolve matters of a private nature or any potential property-boundary dispute; I therefore request that expediente 23-021047-0007-CO be closed.”
  4. 10By decision issued at 05:48 hours on 16 de octubre de 2023, the reporting justice expanded the proceedings and requested a report from the Director of the Área Rectora de Salud de Cartago (see electronic record).
  5. 11Carlos Alberto Granados Siles, in his capacity as Director, Dirección Área Rectora Salud Cartago, states under oath (see electronic record) as follows: “a) After reading and reviewing the case, it has been determined that the address stated in the complaint is not located in the canton of Cartago but in Provincia de Heredia, specifically in Barreal de Heredia, Dirección1228 250 m north and 25 m west. Accordingly, responsibility for handling the case lies with Dirección Área Rectora Salud Heredia and not with this Institution, because the complaint falls outside the territorial jurisdiction of the canton of Cartago.”
  6. 12By decision issued at 22:27 hours on 25 de octubre de 2023, the reporting justice corrected the clerical error (error material) in the decision issued at 05:48 hours on 16 de octubre de 2023 (see electronic record).
  7. 13Carlos Alberto Granados Siles, in his capacity as Director, Dirección Área Rectora Salud Cartago, reports under oath (see electronic record) as follows: “1. On 02 November 2023, the property of Ms. [Nombre 002], located on the west side of the Barrio Fátima sports field, El Carmen district, Cartago, was visited, where I was received by Ms. [Nombre 002] and her son, Mr. [Nombre 001], who explained the problem to me. The land (pastureland) was inspected; it adjoins several dwellings located along the public street called Dirección1229, which is 18 meters wide, and along the edge of Reserva Nacional Los Diques. Because this is an illegal settlement, shack-type dwellings can be seen, with wastewater and stormwater discharged directly onto the affected property, specifically into the pastureland area where no dwelling has been built. 2. The settlement in Los Diques is illegal, and the land does not meet the conditions for the installation of wastewater disposal and treatment systems; therefore, the Ministerio de Salud cannot issue orders to each family living in this area to resolve this problem. 3.It is important to state that this illegal shantytown settlement in Los Diques is growing disproportionately and without order because the local government, as the land-use administrator, has not exercised oversight or adopted measures to prevent such situations. 4. In relation to the matters set forth in the preceding points, which demonstrate that dwellings have been constructed without the required municipal permits in that settlement located on a public street and along one edge of the reserve, it is important to invoke Article 6 of the Ley de Construcciones concerning building permits: “…Without prejudice to the exception for public buildings established in the Ley de Construcciones, Ley N°833 and its amendments, or the regulations replacing it, the building permit or license for any type of work must be processed by a responsible professional in accordance with the guidelines established in these Regulations and the municipal regulations in force.The municipality shall establish the period of validity of such permit or license. Before issuing and granting the building permit, the municipality must verify that the work to be performed complies with the terms of the land-use certificate (certificado de uso del suelo). The municipality must verify that buildings and projects are not located in areas vulnerable to natural hazards or disaster risk. Minor works are exempt from the requirement to obtain a building license or permit, as established in Ley de Construcciones N° 833 and its amendments, or the regulations replacing it.” 5. The provisions of Article 1 of the Ley de Construcciones are determinative; it states: “Article 1.- The Municipalities of the Republic are responsible for ensuring that cities and other population centers meet the necessary conditions of safety, sanitation, convenience, and beauty in their public roads and in the buildings and structures erected on land within them, without prejudice to the powers granted by law in these matters to other administrative bodies.” Moreover, Article 87 of the same law provides: “Article 87.The Municipality shall exercise oversight over works carried out within its jurisdiction, as well as over the uses to which they are put. Municipal inspectors are its agents, whose mission is to ensure compliance with the provisions of these Regulations.” Lastly, Article 60 of the Ley Orgánica del Ambiente provides: “Article 60.- Prevention and control of pollution. To prevent and control environmental pollution, the State, the municipalities, and all other public institutions shall give priority, among other matters, to establishing and operating adequate services in areas essential to environmental health, such as: (…) b) The sanitary disposal of excreta, sewage, and stormwater.” He requests that the appeal be dismissed.
  8. 14The legal requirements have been observed in the proceedings conducted.

Justice Cruz Castro drafted the opinion; and,

Considering:

I. SUBJECT MATTER OF THE APPEAL

The petitioner alleges that the fence on his property was torn down by trespassers so that they could begin illegal construction and that they also blocked the exit belonging to them on the western side of the property. He states that, since 2018, he has repeatedly requested the intervention of the Departamento de Urbanismo and the Alcaldía, both of the Municipalidad de Cartago, which have acted with complete tolerance and inaction regarding these events, alleging that the matter falls not within their jurisdiction but within that of the Ministerio de Obras Públicas y Transportes. He argues that the circumstances described have caused him and his mother—an 84-year-old older adult protected in these proceedings—terrible psychological, emotional, and financial problems, as they receive sewage, stormwater, and tons of garbage on their property and are subjected to insults, objects being thrown, harm to and mistreatment of their animals, damage to the property, theft, and intrusion by unknown persons.

Furthermore, regarding the requirement and obligation to build sidewalks at residential properties, he states that he was notified on 4 December 2015 that he was required to build the sidewalk, which was appraised and valued at 1.241.876,09 colones; however, the adjoining neighbor was notified only because of the petitioner’s own insistence—in pursuit of equal treatment—and was also charged a lower amount.

II. PROVEN FACTS

The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent authority failed to address them, as directed in the initial order:

  • a)By official letter LB-765-2015 dated 04 December 2015, the Municipalidad de Cartago ordered Nombre9363 to build the sidewalk along the southern side of the property identified by property number 3045946-000 (see report of the respondent authority).
  • b)By official letter DVOP-DI-DC-PV-S-2019-3326 dated 19 September 2019, the Dirección de Ingeniería del MOPT informed the petitioner that “the property described in registered survey plan N°C-299968-1996 (…) recorded in the Registro Público de la Propiedad under real-property folio numbers 3045946-000- and 3084681-000 (…) is ‘PARTIALLY’ affected by the DIQUE protection zone, pursuant to Decreto Ejecutivo: N°22834 M.O.P.T.V.A.H. (…) The affected area consists of a line parallel to the line between vertices 10 and 11, shifted 25.00 meters into the property. I further state that the road adjoining the property to the South and East falls under municipal jurisdiction, as established in Chapter I and related provisions of the Ley General de Caminos Públicos. Accordingly, any authorization for construction on the aforementioned property shall be at the discretion and under the responsibility of the local Municipality” (see report of the respondent authority).
  • c)On 11 October 2023, the municipal authorities conducted an inspection and concluded: “Regarding point 1, an inspection was conducted up to the apparent boundaries (linderos) of the property; the boundaries could not be determined because there are no physical markers delimiting the property. As for the alleged obstruction, none exists, because the property in question adjoins the foot of the dike. This is demonstrated by the land-registry and cadastral records reflected in cadastral plan C-299965-1996 and the land-registry report included herein, which show that the property under review neither adjoins nor maintains any type of access” (see report of the respondent authority).
  • d)The Los Diques settlement is illegal, and therefore the land does not meet the conditions for the installation of wastewater disposal and treatment systems; accordingly, the Ministerio de Salud cannot issue orders to each family living in that area (see report of the respondent authority).
  • e)The residents of the human settlement known as Dique have received water from a public standpipe on humanitarian grounds for approximately 15 years (see report of the respondent authority).
  • f)The illegal shantytown settlement in Los Diques is growing disproportionately and without order (see report of the respondent authority).
  • g)One of the dwellings has an outlet discharging graywater (aguas jabonosas) (see report of the respondent authority).
  • h)Three of the dwellings lack gutters and downspouts capable of channeling water to a suitable discharge point (see report of the respondent authority).

III. UNPROVEN FACTS

The following facts are not deemed proven:

  • a)That the Municipalidad de Cartago authorized the installation of any potable-water storage infrastructure adjoining the petitioner’s property.
  • b)That an obstruction exists at the western entrance to property number 3045946-000.

IV. REGARDING THE SPECIFIC CASE

From the reports submitted by the respondent authorities (autoridades recurridas), which were given under oath with the legal consequences that this entails, it follows that, by official letter LB-765-2015 dated 04 de diciembre del 2015, the Municipalidad de Cartago ordered Nombre9363 to construct the sidewalk along the southern side of the property bearing property number 3045946-000. It was established that, by official letter DVOP-DI-DC-PV-S-2019-3326 dated 19 de setiembre del 2019, the Dirección de Ingeniería del MOPT informed the petitioner (recurrente) that “the property described in registered survey plan N°C-299968-1996 (…) recorded in the Registro Público de la Propiedad under real-property folio number: 3045946-000- and Placa1113 (…) is ‘PARTIALLY’ affected by the DIKE protection zone, pursuant to Executive Decree: N°22834 M.O.P.T.V.A.H. (…) This encumbrance consists of a line parallel to the line from vertices 10 to 11, shifted 25.00 meters inward into the property.

I further state that the road adjoining the property to the South and East falls under municipal jurisdiction, as established in Chapter I and related provisions of the Ley General de Caminos Públicos. Accordingly, any authorization for construction on the aforementioned property shall be at the discretion and under the responsibility of the local Municipalidad.” It was demonstrated that, on 11 de octubre de 2023, the municipal authorities conducted an inspection and concluded: “With respect to point 1, an inspection was conducted up to the apparent boundaries (linderos) of the property, but the boundaries could not be determined, as there are no physical limits demarcating the property. As for the alleged blockage, none exists, because the property at issue adjoins the foot of the dike; this is demonstrated in the land-registration and cadastral records embodied in cadastral plan C-299965-1996 and the attached registry report, according to which the property under review neither adjoins nor maintains any type of access.” It was established that the Los Diques settlement is illegal and that the land therefore does not meet the conditions for installing wastewater disposal and treatment systems—accordingly, the Ministerio de Salud cannot issue orders to each family living in that area.

It was verified that the human settlement known as Dique has received water from a public standpipe on humanitarian grounds for approximately 15 years. It was proven that the illegal shantytown settlement in Los Diques is growing disproportionately and without proper planning. It was found that one of the homes discharges graywater (aguas jabonosas) and that three of the homes lack gutters and downspouts capable of channeling the water to a suitable discharge point. Furthermore, it was not possible to establish that the Municipalidad de Cartago had authorized the installation of any drinking-water storage infrastructure adjoining the petitioner’s property, nor that there was a blockage at the western entrance to property number Placa1114. Based on the foregoing, the following conclusions may be drawn:

  • 1)The Los Diques settlement is illegal and the land does not meet the conditions for installing wastewater disposal and treatment systems;
  • 2)Wastewater and stormwater from illegal settlements in the Los Diques sector are discharged onto the pastureland area of the petitioner’s property;
  • 3)It is not true that there is a blockage at the western entrance to property number Placa1114. The municipal authorities, for their part, assert that responsibility for maintaining the dike lies with the Ministerio de Obras Públicas y Transportes; however, the underlying problem is not a lack of maintenance, but rather the disposal and treatment of wastewater from an illegal settlement whose population is increasing daily. Accordingly, that omission cannot now be justified—as the respondent mayor seeks to do—by assigning all responsibility and jurisdiction to the authorities of the Ministerio de Obras Públicas y Transportes, when it is clear that a problem arising from the irregular flow of water and the manner in which certain residents have settled at the location under review—which appears to have been unlawful—is also a matter that must be addressed by this country’s municipalities, as the health authorities demonstrated during their inspection. Under these circumstances, this constitutional body finds that the authorities of the Municipalidad de Cartago have violated the petitioners’ fundamental rights. With respect to the Ministerio de Obras Públicas y Transportes and the Ministerio de Salud, this Court finds no grounds for granting the writ of amparo (amparo).

V.With regard to construction of the sidewalk, it must be noted that this Chamber does not oversee the legality of administrative acts or decisions and therefore lacks jurisdiction to review whether the requested relief is appropriate or whether it complies with the applicable legal rules, as that task belongs to the ordinary administrative or judicial proceedings. Whether the works that the petitioner believes the Municipalidad de Cartago should undertake are appropriate is not a matter to be adjudicated in this Jurisdiction, because it falls outside the scope of its authority. In view of the foregoing, the petitioner must submit his claims to the respondent Municipalidad itself through the remedies available under the Código Municipal or, failing that, through the corresponding judicial proceedings. For these reasons, the amparo is inadmissible with respect to this claim.

VI.Finally, regarding the alleged blockage at the western entrance to property number Placa1114, the inspection conducted did not establish that such an obstruction exists.

VII. CONCLUSION

Under these circumstances, this amparo shall be granted solely against the Municipalidad de Cartago, under the terms set forth in the operative portion of this judgment. With respect to construction of the sidewalk and the alleged blockage at the western entrance to the property, the petition is denied. With respect to the Ministerio de Obras Públicas y Transportes and the Ministerio de Salud, the petition is denied.

VIII. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is the undersigned’s position that, where the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative-law courts. Nevertheless, I do address the merits when other rights of persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (article 50, de la Constitución Política), as occurs in this case, in which the petitioner alleges that the fence surrounding his property was torn down by trespassers to begin illegal construction and that they also blocked the access to which they are entitled on the western side of the property. He states that, since 2018, he has repeatedly requested the intervention of the Departamento de Urbanismo and the Alcaldía, both of the Municipalidad de Cartago, which have shown complete tolerance of and inaction regarding these events, claiming that the matter falls not within their jurisdiction but within that of the Ministerio de Obras Públicas y Transportes.

He argues that the circumstances described cause him and his mother—an older adult aged 84 years who is also protected by this amparo—severe psychological, moral, and financial harm, because their property receives sewage, stormwater, and tons of garbage, and because they have been subjected to insults, objects being thrown, damage to and mistreatment of their animals and property, theft, and intrusion by unknown persons. The foregoing violates the right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.

IX. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve them from the court office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in the Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.

Por tanto:

The petition is partially granted. Mario Redondo Poveda, in his capacity as Mayor, and Juan Carlos Guzmán Víquez, Director de Urbanismo Municipal, both of the Municipalidad de Cartago, or whoever may hold those offices in their stead, are ordered to issue the appropriate directives and coordinate everything necessary with the competent public institutions so that, within a maximum period of THREE MONTHS from service of this judgment, all improvement works necessary to prevent the residents of the illegal Los Diques settlement from discharging wastewater and stormwater onto the pastureland area where the petitioners reside are carried out. The foregoing is ordered with the warning that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order from this Chamber that he or she is required to comply with or enforce and who fails to do so shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty.

The Municipalidad de Cartago is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, to be assessed during enforcement of the judgment before the administrative-law courts. With respect to the Ministerio de Obras Públicas y Transportes and the Ministerio de Salud, the petition is denied. Justice Salazar Alvarado files a note. Let notice be served.

San José, a las nueve horas treinta minutos del diecisiete de noviembre de dos mil veintitres .

Recurso de amparo presentado por [Nombre 001], cédula de identidad número [CED62 ], a favor de [Nombre 002], cédula de identidad número [CED104 ], contra la MUNICIPALIDAD DE CARTAGO y el MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES.

Resultando:

  1. 1Por escrito presentado en la Secretaría de esta Sala a las 13:42 horas del 30 de agosto del 2023 el recurrente presenta recurso de amparo contra la MUNICIPALIDAD DE CARTAGO y el MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES. Manifiesta que desde hace cerca de 50 años sus padres adquirieron una propiedad ubicada en la provincia de Cartago, cantón Central, distrito Occidental, costado oeste de la plaza de deportes de Dirección1227 , en la que viven y mantienen ganado vacuno. Agrega que el terreno colinda al oeste con una calle de 20 metros y con la Reserva Nacional los Diques; reserva que fue invadida ilegalmente por personas nacionales y extranjeras desde hace aproximadamente 6 años. Acusa que la cerca de su propiedad fue arrancada por los invasores para iniciar con las construcciones ilegales, así como le bloquearon la salida que les corresponde al lado oeste de la finca. Señala que desde 2018, ha solicitado en múltiples ocasiones, la intervención del Departamento de Urbanismo y de la Alcaldía, ambos de la Municipalidad de Cartago, quienes han actuado con total tolerancia e inoperancia de los hechos, alegando que no es su competencia sino del Ministerio de Obras Públicas y Transportes -lo cual desmiente toda vez que les corresponde el control constructivo y urbanístico del cantón- existiendo un claro incumplimiento de deberes e inacción municipal, máxime tratándose de un bien demanial -la Reserva Nacional Los Diques- así como de propiedades privadas de las personas que pagan impuestos.Asegura que las viviendas las construyen de manera ilegal durante el día y la noche; además, reciben de manera ilegal el servicio de luz y agua potable -por medio de un tanque 10.000 litros que les colocaron-. Argumenta que lo descrito le genera a él y a su madre -persona adulta mayor de 84 años aquí amparada- terribles problemas psicológicos, morales y económicos -al recibir aguas negras, pluviales, basura por toneladas en su propiedad, insultos, lanzamiento de objetos, daños y maltratos a sus animales, así como a la propiedad, robos, invasión de personas desconocidas-. Argumenta que cuando llaman a la Policía Municipal, les indican que es competencia del Departamento de Urbanismo; mientras que de este último les indican que no pueden hacer nada porque ya las construcciones están hechas; sin embargo, estima que deberían demoler esas construcciones ilegales. Asimismo, cuando llaman a la Fuerza Pública les indican que no es su competencia.Por otra parte, refiere que respecto a la exigencia y obligatoriedad de construir aceras en las viviendas; acusa que fue notificado el 4 de diciembre de 2015, a fin de que construyera la acera, la cual fue tasada y valorada en 1.241.876,09 colones; sin embargo, el vecino colindante no fue notificado sino por su propia insistencia -buscando la equidad- y además le cobraron un monto menor. Por lo expuesto, solicita la intervención de este Tribunal Constitucional.
  2. 2Por resolución de las 17:56 horas del 31 de agosto del 2023 se dio curso al presente amparo y se solicitó informe al alcalde y al director del Departamento de Urbanismo, ambos de la Municipalidad de Cartago, así como el director del Departamento de Previsión Vial del Ministerio de Obras Públicas y Transportes (ver registro electrónico).
  3. 3Informa bajo juramento Mario Redondo Poveda en su condición de Alcalde y Juan Carlos Guzmán Víquez, Director de Urbanismo Municipal, ambos de la Municipalidad de Cartago en los siguientes términos: “Con vista en la referida resolución que contiene recurso de amparo bajo el expediente 23-021047-0007-CO interpuesto por el señor [Nombre 001], cédula de identidad CED7496, a favor de [Nombre 002], cédula de identidad CED7497, contra Municipalidad de Cartago y el Ministerio de Obras Públicas y Transportes, sobre los hechos alegados por el recurrente (sic). Sobre el primer aspecto, la Sala Constitucional mediante el expediente que se indica infra reconoce la tesis de que el MOPT es el órgano competente para dar mantenimiento a los diques.

Con base en lo anterior, y siendo que el amparo se orienta a denunciar la existencia de obras y situaciones que reflejan una falta de mantenimiento del dique, se solicita desde ya, declarar sin lugar este recurso de amparo. En segunda instancia el señor [Nombre 001] registralmente no posee bienes inscritos a su nombre, tal y como se demuestra registralmente:

Así las cosas, los recurrentes no pueden argumentar que se ha actuado con total tolerancia e inoperancia de los hechos, al no tener bienes inscritos a su nombre que se vean perjudicados. Sin perjuicio de lo anterior, y por los hechos que se denuncian, los cuales se orientan precisamente en alegar quebranto a sus derechos constitucionales, en este caso, respecto de una propiedad que no es de su titularidad a y desigualdades en lo que hace a otros propietarios; al no ser reitera propietarios de fundos que sean afectados por los hechos denunciados. Con relación al aspecto de que los moradores de ese sector reciben de manera ilegal (…) y agua potable por medio de un tanque de 10.000 litros, el Director del Eje del Acueducto Municipal manifiesta vía correo de fecha 06 de setiembre de 2023 que: “Buenas Don Nombre6449. Al respecto le puedo informar que en esta área de acueducto no consta que se haya autorizado la instalación de alguna infraestructura de almacenamiento de agua potable en la colindancia con la propiedad de la persona que interpuso el recurso de amparo, por otra parte, también se le informa que este sector en donde se tiene un asentamiento humano denominado dique se surten de paja publica de carácter humanitaria desde hace aproximadamente de 15 años.” A mayor abundamiento mediante Resolución Nº 01739 –2012 del 10 de febrero del 2012 a las 09:05, expediente judicial 12-000685-0007-CO está honorable Camara resolvió “III.- Sobre el fondo.

En lo que concierne al acceso al agua potable como derecho fundamental, entre otras, por sentencia #2007-998 de las 11:15 horas del 26 de enero del 2007, especificó la Sala sus implicaciones, como sigue: La Sala reconoce, como parte del Derecho de la Constitución, un derecho fundamental al agua potable, derivado de los derechos fundamentales a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros, tal como ha sido reconocido también en instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica: (…)."Artículo 11. Derecho a un medio ambiente sano 1. Toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos”. (...). De esto tampoco puede interpretarse que ese derecho fundamental a los servicios públicos no tenga exigibilidad concreta; por el contrario, cuando razonablemente el Estado deba brindarlos, los titulares del derecho pueden exigirlo y no pueden las administraciones públicas o, en su caso, los particulares que los presten en su lugar, escudarse en presuntas carencias de recursos, que ha sido la secular excusa pública para justificar el incumplimiento de sus cometidos.

Nuestra Constitución Política recoge, implícitamente, el derecho fundamental de los administrados al buen y eficiente funcionamiento de los servicios públicos, esto es, que sean prestados con elevados estándares de calidad, el cual tiene como correlato necesario la obligación de las administraciones públicas de prestarlos de forma continua, regular, célere, eficaz y eficiente. IV.- Asimismo, ha aceptado que en los asentamientos humanos que no cumplen las condiciones jurídicas mínimas de habitabilidad se instalen fuentes públicas de agua potable, sin que pueda derivarse del derecho fundamental señalado la obligación de instalar servicios individuales para los habitantes del lugar, debido, justamente, a la falta de condiciones urbanísticas mínimas”. Con vista en lo anterior, el recurso de amparo que se intenta es temerario y desproporcionado, en primera instancia porque existe jurisprudencia constitucional referente a quien le corresponde las obras de mantenimiento de los diques del Rio Reventado, así como, lo relativo a la dotación de servicios públicos que igualmente está tutelado como un derecho constitucional.

Por último, en lo que hace a invasiones a propiedad privada la Comuna no es competente para dirimir conflictos de linderos, por lo que se solicita a su Autoridad Judicial con el debido respeto rechazar de plano el recurso que se intenta por temerario y desproporcionado”. Solicita que se declare sin lugar el recurso.

  1. 4Según constancia suscrita por el Auxiliar Judicial y el Secretario del Despacho no apareció que del cuatro al dieciocho de septiembre del 2023, el DIRECTOR DEL DEPARTAMENTO DE PREVISIÓN VIAL DEL MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las diecisiete horas y cincuenta y seis minutos del treinta y uno de agosto del 2023 (ver registro electrónico).
  2. 5Por resolución de las 18:40 horas del 24 de setiembre del 2023 el magistrado instructor amplió el curso y le solicitó informe al Ministro de Obras Públicas y Transportes (ver registro electrónico).
  3. 6Informa bajo juramento Luis Esteban Amador Jiménez en calidad de Ministro de Obras Públicas y Transportes (ver registro electrónico) en los siguientes términos: “el Ingeniero Eyden Ajoy Arnáez, Jefe del Departamento de Previsión Vial, en fecha 28 de setiembre de 2023, remitió ante la Dirección de Asesoría Jurídica copia de las actuaciones efectuadas por el departamento que representa. Entre los aspectos a valorar adjuntarnos la contestación que efectuó en calidad de Coordinador del Departamento de Previsión Vial, el Ingeniero Luis Diego Rodríguez Chaves ante el Magistrado Fernando Cruz Castro. Cabe señalar que. en dicho informe, el ingeniero Rodríguez Chaves señaló ante la Sala Constitucional lo siguiente:

Como se puede apreciar de la documentación aportada ante la Dirección de Asesoría Jurídica de la Institución, el Departamento de Previsión Vial, contestó en tiempo y forma, el día miércoles 06 de setiembre del año en curso.(se adjunta copia del correo electrónico). No obstante, en el caso que nos ocupa debemos destacar que, son los terrenos ocupados por terceros pertenecieran al Ministerio de Obras Públicas y Transportes, el ente competente para verificar las invasiones al derecho de vía sería el Departamento de Inspección Vial y Demoliciones (…) Sin embargo, después de revisar la denuncia presentada por la señora [Nombre 002], no se evidencia que exista una invasión al derecho de vía, más bien señala ante la Sala Constitucional que existen construcciones ilegales en la Reserva Nacional Los Diques ubicado en la Provincia de Cartago. En razón de lo anterior, es claro y notorio que no hemos podido vulnerar, de modo alguno, los derechos fundamentales de la recurrente, esto por cuanto los permisos de construcción y todo lo referente a inspecciones de salubridad, aguas negras, basura, contaminación y maltrato animal -no corresponde al Ministerio de Obras Públicas y Transportes atender-, por el contrario, dicha problemática le compete al ente Municipal, el cual desde que tiene conocimiento de las presuntas invasiones del cantón, así como las irregularidades que al día de hoy se presentan con las construcciones denunciadas por la señora [Nombre 002], dicha municipalidad debía actuar conforme a sus competencias, esto al existir un Corredor Biológico o Reserva Nacional”. Solicita que se declare sin lugar el recurso.

  1. 7Informa bajo juramento Luis Diego Rodríguez Chaves en calidad de Coordinador del Departamento de Previsión Vial de la División de Obras Públicas del MOPT (ver registro electrónico) en los siguientes términos: “El decreto ejecutivo N° 22334 MOPT - MVAH, en el artículo 5, reza: "Corresponderá a la Dirección General de Viabilidad del Ministerio de Obras Públicas y Transportes, por medio de los departamentos competentes, otorgar el alineamiento pertinente con estricta sujeción a lo que por este decreto se dispone." Por lo anterior, únicamente este departamento, tiene dentro de sus funciones, emitir el alineamiento correspondiente a los Diques, el cual es un requisito que solicita las Municipalidades para el permiso de construcción. Tal como se muestra en el artículo 4, a. sector N° 1, reza: “..EI Ministerio de Recursos Naturales, Energía y Minas regulará la concesión v explotación de los tajos en este sector, y las instituciones públicas de la región, particularmente la Municipalidad de Cartago, ejercieran la fiscalización pertinente. En cualquier trámite deberá darse, de previo, audiencia a la Comisión Nacional de Emergencia a efecto de que emita la opinión pertinente”. Solicita que se declare sin lugar el recurso.
  2. 8Por resolución de las 14:12 horas del 08 de octubre del 2023 el magistrado instructor solicitó como prueba para mejor resolver a Mario Redondo Poveda en su condición de Alcalde y Juan Carlos Guzmán Víquez, Director de Urbanismo Municipal, ambos de la Municipalidad de Cartago que llevaran a cabo una inspección in situ e informen lo siguiente: 1.) ¿Si existe algún bloqueo en la entrada oeste de la finca número 3045946-000?; 2.) ¿Si el asentamiento humano denominado dique genera en la finca número 3045946- 000 problemas de aguas negras, aguas pluviales, y/o contaminación por mal manejo de residuos? (ver registro electrónico).
  3. 9Informa bajo juramento Mario Redondo Poveda en su condición de Alcalde y Juan Carlos Guzmán Víquez, Director de Urbanismo Municipal, ambos de la Municipalidad de Cartago en los siguientes términos: “Referente a fin de que se lleve a cabo una inspección in situ e informen a esta Sala lo siguiente: ¿Si existe algún bloqueo en la entrada oeste de la finca número 3045946-000? En cuanto a realizar inspección in situ, ello se realizó en fecha 11 de octubre de 2023 al ser las 13:53 horas en presencia del Arq. Juan Carlos Guzman Viquez, Director de Urbanismo Municipal, en el sitio es atendido por el señor Wagner [Nombre 001], cédula de identidad CED7496 en su calidad de Nombre9362 (no demuestra documento alguno). En cuanto al punto 1 se realiza recorrido hasta los eventuales linderos de la propiedad, no pudiendo determinarse linderos, no hay límites físicos que delimiten la propiedad. En cuanto al aparente bloqueo, no existe el mismo, ya que la finca de marras colinda con el pie del dique, ello, se demuestra registral y catastralmente materializado en el plano de catastro C-299965-1996, y el informe registral insertos, en donde la finca objeto de estudio no colinda, ni mantiene ningún tipo de acceso. 2.) ¿Si el asentamiento humano denominado dique genera en la finca número 3045946- 000 problemas de aguas negras, aguas pluviales, y/o contaminación por mal manejo de residuos?Sin perjuicio del hecho de que se indica con el debido respeto a esta Sala que lo solicitado excede las competencias municipales, por cuanto informar si existe contaminación o problemas por aguas negras, pluviales o de mal manejo de residuos es materia del Ministerio de Salud -rectius: Área Rectora de Salud de Cartago- por tratarse de materia sanitaria al amparo de los artículos 1, 275, 285, 287, 288, 292 y 313.8 b) de la Ley General de Salud se tiene que: “ARTICULO 1º.- La salud de la población es un bien de interés público tutelado por el Estado. ARTICULO 275.- Queda prohibido a toda persona natural o jurídica contaminar las aguas superficiales, subterráneas y marítimas territoriales, directa o indirectamente, mediante drenajes o la descarga o almacenamiento, voluntario o negligente, de residuos o desechos líquidos, sólidos o gaseosos, radiactivos o no radiactivos, aguas negras o sustancias de cualquier naturaleza que, alterando las características físicas, químicas y biológicas del agua la hagan peligrosa para la salud de las personas, de la fauna terrestre y acuática o inservible para usos domésticos, agrícolas, industriales o de recreación.ARTICULO 285.- Las excretas, las aguas negras, las servidas y las pluviales, deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad. ARTICULO 287.- Toda persona natural o jurídica propietaria de viviendas o de establecimientos o edificios en que las personas desarrollen sus actividades, responderá de que tales bienes dispongan de un sistema de disposición de excretas y de aguas negras y servidas aprobado por el Ministerio y los usuarios de viviendas, establecimientos o edificios estarán obligados a mantener dicho sistema en buenas condiciones de funcionamiento. ARTICULO 288.- Todo propietario queda obligado a conectar el sistema de eliminación de excretas de aguas negras y servidas de su propiedad al alcantarillado sanitario en los lugares en que éste estuviera en funcionamiento, salvo en los casos de excepción que los reglamentos pertinentes reconozcan como procedentes.ARTICULO 292.- Queda prohibido en todo caso la descarga de las aguas negras, de las aguas servidas y de residuos industriales al alcantarillado pluvial. El Ministerio que da facultado para restringir, regular, o prohibir la eliminación de productos sintéticos no biodegradables a través de los sistemas de recolección de excretas, aguas negras y servidas. ARTICULO 313.- Toda vivienda individual, familiar o multifamiliar, deberá cumplir con los siguientes requisitos sanitarios: b) Sistemas adecuados de eliminación de excretas, de aguas negras, servidas y pluviales aprobados por la autoridad de salud”. En cuanto al alegado manejo de aguas jabonosas, negras y pluviales, solamente se aprecia una salida de agua jabonosa de una vivienda. En cuanto al alegado manejo aguas pluviales, se aprecian 3 viviendas que no cuentan con canoas y bajantes que logren canalizar las aguas hacia un punto idóneo para el desfogue de las mismas.En virtud de lo anterior, respetuosamente se solicita a su Autoridad Judicial declarar sin lugar en todos sus extremos el recurso de amparo que se intenta por infundado, temerario y desproporcionado, dado que la Comuna no le compete resolver situaciones de índole privado, eventual problemática de linderos, por lo que ruego se archive el expediente 23-021047-0007-CO”.
  4. 10Por resolución de las 05:48 horas del 16 de octubre de 2023 el magistrado instructor amplió el curso y solicitó informe al Director (a) del Área Rectora de Salud de Cartago (ver registro electrónico).
  5. 11Informa bajo juramento Carlos Alberto Granados Siles en su calidad de director, Dirección Área Rectora Salud Cartago (ver registro electrónico) en los siguientes términos: “a) Luego de la lectura y revisión del caso se determina que la dirección de la denuncia planteada no corresponde al cantón de Cartago, que se limita a la provincia de Heredia, específicamente en Barreal de Heredia, Dirección1228 250 m al norte y 25 m al oeste, por lo que la atención del caso corresponde a la Dirección Área Rectora Salud Heredia y no a ésta Institución por cuanto la querella se encuentra fuera de la zona de atracción del cantón de Cartago”.
  6. 12Por resolución de las 22:27 horas del 25 de octubre de 2023 el magistrado instructor corrigió el error material de la resolución de las 05:48 horas del 16 de octubre de 2023 (ver registro electrónico).
  7. 13Informa bajo juramento Carlos Alberto Granados Siles en su calidad de director, Dirección Área Rectora Salud Cartago (ver registro electrónico) en los siguientes términos: “1.El 02 de noviembre de 2023, se visitó la propiedad de la señora [Nombre 002], ubicada costado Oeste de la plaza de deportes de Barrio Fátima, distrito El Carmen, Cartago, donde me atendieron la Sra. [Nombre 002] y el hijo Sr. [Nombre 001], quienes me explicaron la problemática. Se visita el terreno (pastizal) que colinda con unas viviendas ubicadas sobre la calle pública, llamada Dirección1229 con un ancho de 18 metros, y sobre la orilla de la Reserva Nacional Los Diques, por lo que es un asentamiento ilegal se observan viviendas tipo rancho, con descarga directa de aguas residuales y pluviales a la propiedad afectada, específicamente en el área de pastizal donde no hay ninguna vivienda construida. 2. El asentamiento en los Diques es ilegal y el terreno no reúne condiciones para la instalación de sistemas de disposición y tratamiento de aguas residuales, por tanto, el Ministerio de Salud no puede emitir ordenamientos a cada familia que habita en esta zona, para la solución de este problema. 3.Es importante indicar que dicho asentamiento ilegal de tugurios en los Diques va en aumento de forma desproporcionada y desordenada, debido a que el gobierno local como administrador del uso del suelo, no ha ejercido vigilancia y medidas para evitar ese tipo de situaciones. 4.En relacion con lo esgrimido en los puntos anteriores donde se evidencia la construccion de viviendas sin los debidos permisos municipales en ese asentamiento sobre calle pública y una orilla de la reserva es importante invocar el artículo 6 de la Ley de construcciones referentes a permiso de construcción “…Sin perjuicio de la excepción para edificaciones públicos, establecida en la Ley de Construcciones, Ley N°833 y sus reformas o la normativa que la sustituya, el permiso o licencia de construcción de cualquier tipo de obra, debe ser tramitado por un profesional responsable, de acuerdo con los lineamientos establecidos en el presente Reglamento, y las regulaciones municipales vigentes.La municipalidad establece la vigencia de dicho permiso o licencia. Previo a emitir y otorgar el permiso de construcción, la municipalidad debe verificar que la obra a realizar sea conforme a los términos del certificado de uso del suelo. La municipalidad debe comprobar que las edificaciones y proyectos no se ubiquen en zonas vulnerables de amenazas naturales o riesgo de desastre. Se exceptúa del requisito de licencia o permiso de construcción aquellas obras menores, según lo establecido en Ley de Construcciones N° 833 y sus reformas o la normativa que la sustituya". 5. Es determinante lo dispuesto en el artículo 1 de la Ley de Construcciones, según el cual: “Artículo 1.- Las Municipalidades de la República son las encargadas de que las ciudades y demás poblaciones reúnan las condiciones necesarias de seguridad, salubridad, comodidad y belleza en sus vías públicas y en los edificios y construcciones que en terrenos de estas se levanten sin perjuicio de las facultades que las leyes conceden en estas materias a otros órganos administrativos”.Por otra parte, el artículo 87 de la misma ley establece que: “Artículo 87. La Municipalidad ejercerá vigilancia sobre las obras que se ejecuten en su jurisdicción, así como sobre el uso que se les esté dando. Los inspectores municipales son sus agentes, que tienen por misión vigilar la observancia de los preceptos de este Reglamento”. Por último, el artículo 60 de la Ley Orgánica del Ambiente, dispone que: “Artículo 60.- Prevención y control de la contaminación Para prevenir y controlar la contaminación del ambiente, el Estado, las municipalidades y las demás instituciones públicas, darán prioridad, entre otros, al establecimiento y operación de servicios adecuados en áreas fundamentales para la salud ambiental, tales como: (…) b) La disposición sanitaria de excretas, aguas servidas y aguas pluviales”. Solicita que se declare sin lugar el recurso.
  8. 14En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I. OBJETO DEL RECURSO

El recurrente alega que la cerca de su propiedad fue arrancada por invasores para iniciar con construcciones ilegales, así como le bloquearon la salida que les corresponde al lado oeste de la finca. Señala que desde 2018, ha solicitado en múltiples ocasiones, la intervención del Departamento de Urbanismo y de la Alcaldía, ambos de la Municipalidad de Cartago, quienes han actuado con total tolerancia e inoperancia de los hechos, alegando que no es su competencia sino del Ministerio de Obras Públicas y Transportes. Argumenta que lo descrito le genera a él y a su madre -persona adulta mayor de 84 años aquí amparada- terribles problemas psicológicos, morales y económicos -al recibir aguas negras, pluviales, basura por toneladas en su propiedad, insultos, lanzamiento de objetos, daños y maltratos a sus animales, así como a la propiedad, robos, invasión de personas desconocidas-. Por otra parte, refiere que respecto a la exigencia y obligatoriedad de construir aceras en las viviendas; acusa que fue notificado el 4 de diciembre de 2015, a fin de que construyera la acera, la cual fue tasada y valorada en 1.241.876,09 colones; sin embargo, el vecino colindante no fue notificado sino por su propia insistencia -buscando la equidad- y además le cobraron un monto menor.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

  • a)Que mediante oficio LB-765-2015 de fecha 04 de diciembre del 2015 la Municipalidad de Cartago le ordenó a Nombre9363 la construcción de la acera al costado sur de la propiedad con el número de finca 3045946-000 (ver informe de la autoridad recurrida).
  • b)Que mediante oficio DVOP-DI-DC-PV-S-2019-3326 de fecha 19 de setiembre del 2019 la Dirección de Ingeniería del MOPT le indicó al recurrente que “la propiedad descrita en el plano catastrado N°C-299968-1996 (…) inscrita en el Registro Público de la Propiedad no número de folio real: 3045946-000- y 3084681-000 (…) se encuentra “PARCIALMENTE” afectada por la zona de protección al DIQUE, según el Decreto Ejecutivo: N°22834 M.O.P.T.V.A.H. (…) Dicha afectación es una línea paralela de los vértices 10 al 11 desplazada 25.00 metros terreno adentro de la propiedad. No omito manifestar que la vía colindante al Sur y al Este de la propiedad, es de competencia municipal, conforme lo establece el Capítulo I y concordantes de la Ley General de Caminos Públicos. Por lo que cualquier autorización de construcción en la propiedad antes mencionada, quedará a criterio y responsabilidad de la Municipalidad del lugar” (ver informe de la autoridad recurrida).
  • c)Que en fecha 11 de octubre de 2023 las autoridades municipales realizaron una inspección y concluyeron: “En cuanto al punto 1 se realiza recorrido hasta los eventuales linderos de la propiedad, no pudiendo determinarse linderos, no hay límites físicos que delimiten la propiedad. En cuanto al aparente bloqueo, no existe el mismo, ya que la finca de marras colinda con el pie del dique, ello, se demuestra registral y catastralmente materializado en el plano de catastro C-299965-1996, y el informe registral insertos, en donde la finca objeto de estudio no colinda, ni mantiene ningún tipo de acceso” (ver informe de la autoridad recurrida).
  • d)Que el asentamiento Los Diques es ilegal por lo que el terreno no reúne condiciones para la instalación de sistemas de disposición y tratamiento de aguas residuales -por tanto, el Ministerio de Salud no puede emitir ordenamientos a cada familia que habita en esa zona- (ver informe de la autoridad recurrida).
  • e)Que en el asentamiento humano denominado Dique se surten de paja publica de carácter humanitaria desde hace aproximadamente de 15 años (ver informe de la autoridad recurrida).
  • f)Que el asentamiento ilegal de tugurios en Los Diques va en aumento de forma desproporcionada y desordenada (ver informe de la autoridad recurrida).
  • g)Que una de las viviendas tiene salida de aguas jabonosas (ver informe de la autoridad recurrida).
  • h)Que tres de las viviendas no cuentan con canoas y bajantes que logren canalizar las aguas hacia un punto idóneo para el desfogue de las mismas (ver informe de la autoridad recurrida).

III. HECHOS NO PROBADOS

No se estiman como probados los siguientes hechos:

  • a)Que la Municipalidad de Cartago haya autorizado la instalación de alguna infraestructura de almacenamiento de agua potable en la colindancia con la propiedad del recurrente.
  • b)Que exista un bloqueo en la entrada oeste de la finca número 3045946-000.

IV. SOBRE EL CASO CONCRETO

De los informes rendidos por las autoridades recurridas los cuales son dados bajo la solemnidad del juramento con las consecuencias legales que ello implica se desprende que mediante oficio LB-765-2015 de fecha 04 de diciembre del 2015 la Municipalidad de Cartago le ordenó a Nombre9363 la construcción de la acera al costado sur de la propiedad con el número de finca 3045946-000. Se acreditó que mediante oficio DVOP-DI-DC-PV-S-2019-3326 de fecha 19 de setiembre del 2019 la Dirección de Ingeniería del MOPT le indicó al recurrente que “la propiedad descrita en el plano catastrado N°C-299968-1996 (…) inscrita en el Registro Público de la Propiedad no número de folio real: 3045946-000- y Placa1113 (…) se encuentra “PARCIALMENTE” afectada por la zona de protección al DIQUE, según el Decreto Ejecutivo: N°22834 M.O.P.T.V.A.H. (…) Dicha afectación es una línea paralela de los vértices 10 al 11 desplazada 25.00 metros terreno adentro de la propiedad.

No omito manifestar que la vía colindante al Sur y al Este de la propiedad, es de competencia municipal, conforme lo establece el Capítulo I y concordantes de la Ley General de Caminos Públicos. Por lo que cualquier autorización de construcción en la propiedad antes mencionada, quedará a criterio y responsabilidad de la Municipalidad del lugar”. Quedó demostrado que en fecha 11 de octubre de 2023 las autoridades municipales realizaron una inspección y concluyeron: “En cuanto al punto 1 se realiza recorrido hasta los eventuales linderos de la propiedad, no pudiendo determinarse linderos, no hay límites físicos que delimiten la propiedad. En cuanto al aparente bloqueo, no existe el mismo, ya que la finca de marras colinda con el pie del dique, ello, se demuestra registral y catastralmente materializado en el plano de catastro C-299965-1996, y el informe registral insertos, en donde la finca objeto de estudio no colinda, ni mantiene ningún tipo de acceso”.

Se comprobó que el asentamiento Los Diques es ilegal por lo que el terreno no reúne condiciones para la instalación de sistemas de disposición y tratamiento de aguas residuales -por tanto, el Ministerio de Salud no puede emitir ordenamientos a cada familia que habita en esa zona-. Se verificó que en el asentamiento humano denominado Dique se surten de paja publica de carácter humanitaria desde hace aproximadamente de 15 años. Se probó que el asentamiento ilegal de tugurios en Los Diques va en aumento de forma desproporcionada y desordenada. Se constató que una de las viviendas tiene salida de aguas jabonosas y que, tres de las viviendas no cuentan con canoas y bajantes que logren canalizar las aguas hacia un punto idóneo para el desfogue de las mismas. De otra parte no fue posible acreditar que la Municipalidad de Cartago haya autorizado la instalación de alguna infraestructura de almacenamiento de agua potable en la colindancia con la propiedad del recurrente como tampoco que exista un bloqueo en la entrada oeste de la finca número Placa1114. Partiendo de lo anterior es posible concluir lo siguiente:

  • 1)Que el asentamiento en los Diques es ilegal y el terreno no reúne condiciones para la instalación de sistemas de disposición y tratamiento de aguas residuales;
  • 2)Que en el área de pastizal de la propiedad de la recurrente se depositan aguas residuales y pluviales provenientes de asentamientos ilegales del sector de los Diques;
  • 3)Que no es cierto que exista un bloqueo en la entrada oeste de la finca número Placa1114. Por su parte las autoridades municipales afirman que es competencia del Ministerio de Obras Públicas y Transportes darle mantenimiento al dique; sin embargo el problema de fondo no se trata de la falta de mantenimiento sino de la disposición y tratamiento de aguas residuales de un asentamiento ilegal que cada día es más poblado. De manera que dicha omisión no puede ser justificada ahora -tal y como pretende el alcalde recurrido-, atribuyéndole toda la responsabilidad y competencia a las autoridades del Ministerio de Obras Públicas y Transportes, cuando es claro que un problema por el discurrir irregular de las aguas y la forma en que se han asentado algunos pobladores en el sitio bajo estudio (que, al parecer, ha sido irregular), es también un asunto que debe ser atendido por los municipios de este país, tal y como lo demostraron las autoridades sanitarias en la inspección realizada. Así las cosas, este órgano constitucional estima que las autoridades de la Municipalidad de Cartago han vulnerado los derechos fundamentales de los recurrentes. Con respecto al Ministerio de Obras Públicas y Transportes y e Ministerio de Salud, este Tribunal no considera que exista mérito para acoger el amparo.

V.En cuanto a la construcción de la acera, se impone advertir que esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración, de modo que no le compete revisar si la pretensión requerida es procedente, o si se ajusta o no a la normativa legal vigente, labor propia de la vía común, administrativa o jurisdiccional. La procedencia o no de las obras que estima que debe realizar la Municipalidad de Cartago, es un asunto que no debe discutirse en esta Jurisdicción, ya que es ajeno al ámbito de su competencia. En virtud de lo expuesto, deberá el recurrente plantear sus alegatos ante la propia Municipalidad recurrida a través de los recursos que sean aplicables de conformidad con lo dispuesto en el Código Municipal, o en su defecto, en la vía jurisdiccional correspondiente. Por lo expuesto, el amparo resulta inadmisible en cuanto a este extremo.

VI.Finalmente en cuanto al supuesto bloqueo en la entrada oeste de la finca número Placa1114 no se logró comprobar en la inspección realizada que exista dicha obstrucción.

VII. CONCLUSIÓN

Así las cosas procede la estimatoria de este amparo únicamente contra la Municipalidad de Cartago en los términos que se indican en la parte dispositiva de esta sentencia. En cuanto a la construcción de la acera y el supuesto bloqueo de la entrada oeste de la finca se declara sin lugar el recurso. En cuanto al Ministerio de Obras Públicas y Transportes y el Ministerio de Salud se declara sin lugar el recurso.

VIII. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que el recurrente acusa que la cerca de su propiedad fue arrancada por invasores para iniciar con construcciones ilegales, así como le bloquearon la salida que les corresponde al lado oeste de la finca. Señala que desde 2018, ha solicitado en múltiples ocasiones, la intervención del Departamento de Urbanismo y de la Alcaldía, ambos de la Municipalidad de Cartago, quienes han actuado con total tolerancia e inoperancia de los hechos, alegando que no es su competencia sino del Ministerio de Obras Públicas y Transportes.

Argumenta que lo descrito le genera a él y a su madre -persona adulta mayor de 84 años aquí amparada- terribles problemas psicológicos, morales y económicos -al recibir aguas negras, pluviales, basura por toneladas en su propiedad, insultos, lanzamiento de objetos, daños y maltratos a sus animales, así como a la propiedad, robos, invasión de personas desconocidas-. Lo anterior, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

IX. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara parcialmente con lugar el recurso. Se ordena a Mario Redondo Poveda en su condición de Alcalde y Juan Carlos Guzmán Víquez, Director de Urbanismo Municipal, ambos de la Municipalidad de Cartago o a quienes en su lugar ocupen los cargos girar las órdenes pertinentes y coordinar todo lo que sea necesario con las instituciones públicas que sean competentes para que, dentro del plazo máximo de TRES MESES, contado a partir de la notificación de esta sentencia, se lleven a cabo todas aquellas obras de mejora para evitar que los vecinos del asentamiento ilegal Los Diques depositen las aguas residuales y pluviales en el área de pastizal donde habitan los recurrentes. Lo anterior se dicta con la advertencia que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá pena de prisión de tres meses a dos años o de veinte a sesenta día multa a quien reciba una orden de esta Sala que deba cumplir o hacer cumplir y la inobserve, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de Cartago al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto al Ministerio de Obras Públicas y Transportes y el Ministerio de Salud se declara sin lugar el recurso. El Magistrado Salazar Alvarado pone nota. Notifíquese.
