Document Review Decision No. 2023029820 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine thirty on diecisiete de noviembre de dos mil veintitres.

Petition for amparo (recurso de amparo) filed by [Nombre62 001], identity card [CED62 ], against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).

Background:

  1. 1In a filing submitted to the Chamber on 3 de octubre de 2023, the petitioner filed a petition for amparo against the Instituto Costarricense de Acueductos y Alcantarillados. The petitioner states that they reside in Coto Brus. They indicate that, for several years, residents of Coto Brus and surrounding areas have experienced shortages or a lack of potable-water service. They allege that throughout that period they have made various requests to the Instituto Costarricense de Acueductos y Alcantarillados, without a positive result. They state that financing was secured for construction of the water pipeline and approved by the Asamblea Legislativa; however, it has not been implemented due to ICAA’s negligence. They request the intervention of this Constitutional Court.
  2. 2By decision issued at 15:57 on 5 de octubre de 2023, the present petition was admitted for processing, and the executive president and the head of the Coto Brus cantonal office, both of the Instituto Costarricense de Acueductos y Alcantarillados, were ordered to report on the facts alleged by the petitioner.
  3. 3In a filing entered into the electronic case file on 11 de octubre de 2023, Mario Alexander Villarevia Rivera, in his capacity as head of the Coto Brus cantonal office of the Instituto Costarricense de Acueductos y Alcantarillados, reports under oath that: “First: The Instituto Costarricense de Acueducto y Alcantarillados is carrying out the Coto Brus Aqueduct Improvement Project (BPIP 2662). The project consists of II Stages: Stage I: Increasing the Production Capacity of the Coto Brus Aqueduct. This stage provides for the construction of 6 works: capture of springs (nacientes), capture of overflow from the current source, 30km transmission line, implementation of the disinfection system, control and metering, and ancillary works. Stage II: Improvements and expansion of the storage volume, transmission lines, and distribution networks of the Coto Brus Aqueduct. This stage includes communities that currently lack service, such as Villa Roma, Los Pilares, and Campo Tres de Agua Buena.Second: To carry out the second Stage, the Instituto Costarricense de Acueductos y Alcantarillados is conducting a consultancy to determine the needs for improvements to the Coto Brus Aqueduct through INTERNATIONAL PROCUREMENT 2019LI-000012-PRI. Third: The purpose of the consultancy is to ensure that AyA can sustainably provide the service and operate and maintain the aqueduct throughout the project horizon, in order to safeguard the health of the population in the localities within the study area. Fourth: As part of the stages for preparing the feasibility studies, the Consultant will identify short-, medium-, and long-term investment measures for the potable-water systems to guarantee service to the directly and indirectly served population over a 30-year lifespan. Fifth: Within the overall Coto Brus Aqueduct system, the project will use the overflow from the Las Tablas Spring; construct a chlorination building; incorporate transmission and distribution pipeline networks and specialized hydraulic valves; and improve 5 existing pumping units.It will also increase the storage capacity of the following tanks: Linda Vista, Copal, Santa Cecilia, San Antonio, Metaponto, La Maravilla, Santa Teresa, Los Ángeles, La Unión, Chisperos, and La Lucha. In addition, a new tank will be constructed in Copa Buena, in the district of Agua Buena. Sixth: For the Coto Brus system, water will be captured from the overflow of the Las Tablas spring, and an additional pipeline will be constructed from the Las Tablas spring to the community of Sabalito to increase the aqueduct’s resilience and redundancy. Chlorination will take place downstream from the springs, and the water will be stored in the main tanks, which will be expanded and optimized. With respect to tanks, the number of small storage tanks or pressure-break tanks will also be reduced, and the pressure zones and consumption sectors will be consolidated to improve hydraulic performance. This will be supplemented by installing specialized hydraulic valves to regulate pressure ranges in the aqueduct.Part of the distribution pipeline networks will be enlarged to improve potable-water service, improve hydrant performance, expand coverage, and guarantee the integration of the population projected through 2050. Seventh: As part of the immediate work, control valves are being installed in the system’s various sectors. Medium-term work includes improvements to the transmission pipeline networks, distribution networks, control valves, storage tanks, pumping stations, and ancillary works. Eighth: The project has an emergency decree and CNE certification of works under the Plan General de Emergencia (PGE). Ninth: Water shortages in the area occur because leaks develop in the distribution or transmission lines due to the high pressures at which the system must operate in order to reach the highest areas. This results from the highly irregular topography where the aqueduct and the Canton of Coto Brus are located.It should be noted that, in coordination with the Dirección de la Región Brunca, the office has made substantial efforts in recent months to pursue remedial solutions before implementation of the aforementioned project. In connection with this matter, the Region’s engineering department, together with the technical team from the Coto Brus cantonal office, is preparing a diagnostic study to verify the condition and hydraulic performance of the Coto Brus system and identify potential opportunities for improving its operation and optimization using the existing infrastructure. As part of the diagnostic activities, on 22 de agosto del presente año, a field visit was made to the Las Tablas intake, with participation by the Dirección Regional Brunca, Dirección de Agua Potable, the area engineer, and operational personnel from the cantonal office. Using measuring equipment (portable flowmeters), flow measurements were taken in various sectors of the transmission line (Paso Elevado, Clorador) to identify possible losses.The inspection also identified (7) areas where the existing air valves need to be replaced; cantonal technical personnel are arranging this replacement. In addition, flow data generated by the flowmeter located in the Puente Sabalito sector are used and compared with the system’s production to verify, based on the sector model, the consumption of existing service connections for purposes of reviewing losses. Tank-filling behavior is analyzed using the Kolibri platform, which receives data from level controls installed in the aqueduct’s main tanks, to inform decisions regarding valve closures. On this particular point, the Subgerencia de Periféricos provides support through hydraulic modeling of the entire system. It should be emphasized that, as a quality-control measure for service delivery, the Cantonal de San Vito continuously monitors the distribution and transmission networks, principal sources, and storage tanks, and takes pressure readings in various sectors to identify failures promptly, 24 hours a day.Tenth: The operational personnel of the Cantonal de Coto Brus work with staff available 24 hours a day to provide a prompt and efficient response to our users’ needs. The personnel working there allow us to increase response capacity and carry out necessary repairs for failures or leaks within a short period, thereby minimizing the impact on the quality of the service provided. Eleventh: As part of communications with the Coto Brus community, meetings have been held with community groups, Concejo Municipal de Coto Brus, and CCCI de Coto Brus. At those meetings, they were informed of progress on the ‘Coto Brus Aqueduct Improvements’ Project, with participation by AyA personnel at the regional level, the departamento de Programación y Control, and the Unidad Ejecutora AyA-BCIE.” He requests that the petition be denied.
  4. 4In a filing entered into the electronic case file on 11 de octubre de 2023, Luis Alejandro Guillén Guardia, in his capacity as executive president of the Instituto Costarricense de Acueductos y Alcantarillados, reports under oath to the same effect as the head of the Coto Brus cantonal office of the Instituto Costarricense de Acueductos y Alcantarillados. He requests that the petition be denied.
  5. 5The statutory requirements have been observed in the proceedings conducted.

Justice Araya García authored the decision; and,

Considerations:

I.Subject matter of the petition. The petitioner states that they reside in Coto Brus. In that regard, they assert that residents of Coto Brus and surrounding areas experience shortages or a lack of potable-water service and have therefore made various requests to the respondent Institute; however, they have not obtained a positive result. The petitioner maintains that the respondent authority possesses the construction plans; however, as of the date this proceeding was filed, it had not implemented any stage, notwithstanding the fact that financing from the Asamblea Legislativa is available for construction of the water pipeline.

II. Proven facts. The following facts are deemed duly established and relevant to the disposition of this matter

a. The petitioner resides in Coto Brus (undisputed fact); b. The Instituto Costarricense de Acueducto y Alcantarillados is carrying out the Coto Brus Aqueduct Improvement Project (BPIP 2662), which consists of two stages arranged as follows: “Stage I: Increasing the Production Capacity of the Coto Brus Aqueduct. This stage provides for the construction of 6 works: capture of springs, capture of overflow from the current source, 30km transmission line, implementation of the disinfection system, control and metering, and ancillary works. Stage II: Improvements and expansion of the storage volume, transmission lines, and distribution networks of the Coto Brus Aqueduct. This stage includes communities that currently lack service, such as Villa Roma, Los Pilares, and Campo Tres de Agua Buena” (see report submitted under oath and evidence provided); c. The Coto Brus Aqueduct Improvement Project (BPIP 2662) has an emergency decree and CNE certification of works under the Plan General de Emergencia (see report submitted under oath and evidence provided); d. To carry out the second stage of the Coto Brus Aqueduct Improvement Project (BPIP 2662), the Instituto Costarricense de Acueductos y Alcantarillados is conducting a consultancy through INTERNATIONAL PROCUREMENT 2019LI-000012-PRI to guarantee the sustainable provision of water service and the operation and maintenance of the aqueduct over a 30-year lifespan (see report submitted under oath and evidence provided); e. The general features of the Coto Brus Aqueduct Improvement Project include the following: overflow from the Las Tablas springs (nacientes), construction of a chlorination facility, incorporation of transmission and distribution pipeline networks, specialized hydraulic valves, improvements to 5 existing pumping units, increased storage capacity of the following tanks: Linda Vista, Copal, Santa Cecilia, San Antonio, Metaponto, La Maravilla, Santa Teresa, Los Ángeles, La Unión, Chisperos and La Lucha, and construction of a new tank in Copa Buena, in the district of Agua Buena (see sworn report and evidence submitted); f. The water shortage in the Coto Brus sector is due to leaks in the distribution or transmission lines caused by the high pressures at which the system must operate in order to reach the highest areas, given the highly irregular topography where the Instituto Costarricense de Acueducto y Alcantarillados aqueduct is located (see sworn report and evidence submitted); g. On 22 de agosto de 2023, the authorities of the Instituto Costarricense de Acueductos y Alcantarillados conducted a site visit to the Las Tablas intake (captación), with the participation of the Dirección Regional Brunca, Dirección de Agua Potable, the area engineer, and operational personnel from the Cantonal office, who took flow measurements in different sections of the transmission line and identified 7 areas requiring replacement of air valves (see sworn report and evidence submitted); h. The authorities of the Instituto Costarricense de Acueductos y Alcantarillados have presented the progress of the Coto Brus Aqueduct Improvement Project to the community of Coto Brus (see sworn report and evidence submitted); i. The project’s current status is as follows: “PHASE I: INCREASE IN THE PRODUCTION CAPACITY OF THE COTO BRUS AQUEDUCT.

PROGRESS ON TRANSMISSION-LINE DESIGN: 60%. PROGRESS ON DESIGN OF THE NEW INTAKE: 40%. PROGRESS ON LAND-ACQUISITION PROCEDURES: -12 EASEMENT (SERVIDUMBRE) PLANS, INTAKE-AREA PLAN, PRESSURE-BREAK TANK/CHLORINATOR SITE PLAN. -APPRAISALS (AVALÚOS) ARE BEING PREPARED FOR 3 EASEMENTS. -9 EASEMENT SECTIONS AWAITING SINAC APPROVAL (VISADO). (APPROVAL REQUESTED BY THE REGISTRO DE LA PROPIEDAD). -THE SITE PLAN FOR THE PRESSURE-BREAK TANK/CHLORINATOR AND THE INTAKE AREA IS BEING REGISTERED THROUGH POSSESSORY INFORMATION PROCEEDINGS (INFORMACIÓN POSESORIA) AND AWAITS SINAC APPROVAL. -REAL-ESTATE PROCEDURES: CADASTRAL PLANS (PLANOS CATASTRADOS) AND APPRAISALS ARE REQUIRED—THE ADMINISTRATIVE EXPROPRIATION PROCESS IS ESTIMATED TO TAKE APPROXIMATELY 9 MONTHS IF THE OWNERS AGREE. -THE PROJECT HAS AN EMERGENCY DECREE AND CNE WORK CERTIFICATION UNDER THE GENERAL EMERGENCY PLAN (PGE), WHICH ARE IMPORTANT FOR CARRYING OUT EXPEDITED PROCUREMENT PROCESSES. -PROCEDURES BEFORE SETENA (ENVIRONMENTAL VIABILITY [VIABILIDAD AMBIENTAL]), DIRECCIÓN DE AGUAS, AND SINAC WILL BE CARRIED OUT PURSUANT TO THE EMERGENCY DECREE.

(THE CADASTRAL PLANS ARE REQUIRED IN ORDER TO CONSULT SETENA). -APPROXIMATE COST: $31,308,722/ ₡18,100,853,513. -AYA IS TAKING STEPS TO SECURE FINANCING FOR THE PROJECT. -DELIVERY DATE FOR CONSTRUCTION PLANS AND DETAILED PROJECT BUDGET: FEBRERO 2024” (see sworn report and evidence submitted).

III.On the right to the proper functioning of public services and the role of the Instituto Costarricense de Acueductos y Alcantarillados as the governing authority for drinking-water supply. In this regard, in judgment no. 2016012058 at 9:30 hours on 26 de agosto de 2016, this Chamber stated:

“(…) in the case at bar (sub judice), it is determined that ICAA, as the governing authority in this field, has failed to perform its inspection and supervisory duties regarding the provision of the public drinking-water and sewerage service and, therefore, has violated the petitioners’ rights. Pursuant to Articles 1 and 2 of the Ley Constitutiva del Instituto Costarricense Acueductos y Alcantarillados, ICAA is responsible, among other duties, for resolving all matters related to the supply of drinking water and the sanitary sewerage service; directing and overseeing everything necessary to provide residents with drinking-water service; and directly administering and operating aqueduct and sewerage systems throughout the country. It is therefore inexcusable that ICAA failed to act to prevent and remedy a situation such as the present one, in which an ASADA has been providing the aforementioned services without executing any delegation agreement.

In this regard, it is appropriate to recall what the Chamber stated in judgment Nº 2014-012971 at 14:45 hours on 8 de agosto de 2014 concerning ICAA and its duties to oversee and ensure the proper functioning of the public services in question:

“IV.- On the right to the proper functioning of public services and the role of ICAA as the governing authority for water supply. In judgment number 2012-12009 at 09:05 hours on 31 de agosto de 2013, this Chamber ruled as follows, which is relevant to the disposition of the matter at issue (sub lite):

“This Chamber has held that the Political Constitution implicitly recognizes the fundamental right of persons subject to the Administration (administrados) to the proper and efficient functioning of public services, that is, to have those services provided according to high quality standards. The necessary corollary is the obligation of public administrations to provide them continuously, regularly, promptly, effectively, and efficiently. This latter obligation follows from the systematic relationship among several constitutional provisions, such as Article 140, subsection 8 (which imposes on the Executive Branch the duty to ‘Ensure the proper functioning of administrative services and offices’), Article 139, subsection 4 (insofar as it incorporates the concept of the ‘proper conduct of Government’), and Article 191 (insofar as it incorporates the principle of ‘administrative efficiency’).

This Court has also stated that this atypical or unnamed individual guarantee is heightened in the case of essential public services such as drinking-water supply, because interests as precious as human health and life are at stake; accordingly, the principles of effectiveness, efficiency, promptness, continuity, and adaptability must apply with greater rigor (see, to this effect, judgments number 2008-016405 at 19:04 hours on 30 de octubre de 2008 and 2008-017633 at 12:06 hours on 5 de diciembre de 2008). In this context, the role of the Instituto Costarricense de Acueductos y Alcantarillados as the governing authority in this field assumes particular importance. This Chamber has stated that:

“(…) pursuant to Article 1 of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, that autonomous institution was created for the express purpose of directing, setting policies, establishing and applying standards, conducting and promoting planning, financing, and development, and resolving all matters related to the supply of drinking water. To fulfill that purpose, and in accordance with Article 2 of that same body of law, the Instituto Costarricense de Acueductos y Alcantarillados is responsible for directing and overseeing everything necessary to provide the inhabitants of the Republic with drinking-water service, as well as for developing, using, managing, or overseeing, as applicable, all publicly owned waters essential for proper compliance with the provisions of the aforementioned law. This confirms that the Instituto Costarricense de Acueductos y Alcantarillados is the institution primarily responsible for ensuring that all inhabitants of the Republic can benefit from a drinking-water supply system capable of providing that water continuously and in sufficient quantities to adequately meet the basic needs of all persons, thereby effectively safeguarding their fundamental rights to life and health” (judgment number 2011005457 at 11:32 hours on 29 de abril de 2011.)

Consistent with the foregoing, this Chamber has emphasized that, in cases where an ASADA provides water-supply service for human consumption, the Instituto Costarricense de Acueductos y Alcantarillados is required to exercise effective and efficient oversight and control over the respective water-supply system with regard to its operation, maintenance, administration, and development, thereby ensuring its proper functioning (judgment number 2011009487 at 9:15 hours on 22 de julio de 2011). Indeed, more recently, in judgment number 2012006447 at 10:30 hours on 18 de mayo de 2012, this Chamber stated:

“(…) although Article 2 of Ley 2726 authorizes AyA to enter into agreements with community organizations for the administration of aqueduct and sewerage systems, the respondent Institute, as the governing authority in this field, is responsible for all matters relating to the operation, maintenance, administration, and development of the systems necessary to supply water to communities. Based on the foregoing, the Administration cannot excuse the absence of efficient drinking-water service on the grounds of a lack of community organization or poor management of the rural aqueduct by the private concessionaire (…)

This confirms the obligation of the Instituto Costarricense de Acueductos y Alcantarillados to oversee and ensure the proper functioning of community aqueduct systems” (emphasis not in the original) “V.- On the specific case. In the present case, the petitioner alleges that, in the community of El Porvenir de La Cruz, Guanacaste, ICAA provides drinking-water service by delegation to an ASADA; nevertheless, that service is provided inadequately and requires infrastructure improvements. Accordingly, the Municipalidad de La Cruz allocated funds for improvements to that aqueduct, but those funds cannot be used until ICAA conducts the corresponding technical studies. She considers her fundamental right of access to drinking water to have been violated.

In this regard, the Chamber deemed it established that the Asociación Administradora del Acueducto Rural El Porvenir, La Cruz, Guanacaste, does not have current legal personality (personería jurídica vigente), since it expired on 31 de julio de 2007. Likewise, it is evident that ASADA El Porvenir has not submitted to ICAA the documentation required for processing the execution of the delegation agreement (convenio de delegación). Furthermore, ICAA does not have an updated assessment of the water-supply system operated by ASADA El Porvenir. The case record showed that, by official letter number SB-GSC-GA-FA-ORAC-CH-2014-1758 dated 03 de julio de 2014, the Head of the Regional Office of Community Systems for ICAA’s Región Chorotega suggested that ASADA El Porvenir hire a professional to conduct a technical study recommending the improvements required by the water-supply system. Finally, it was demonstrated that the Municipalidad de La Cruz allocated 3 million colones for improvements to the water-supply infrastructure, which will be spent once the corresponding technical studies have been completed.

Given these circumstances, the Chamber considers that the amparo proceeding (amparo) must be partially granted, solely against ICAA. As explained in the preceding recital (considerando), ICAA is obligated to oversee and ensure the proper operation of community water-supply systems and therefore cannot offer as an excuse that the absence of an efficient drinking-water service is attributable to a lack of community organization or poor management of the rural water-supply system. As the governing authority for drinking-water supply, ICAA is called upon to assist in promptly resolving the problem affecting the community of El Porvenir, in La Cruz de Guanacaste. Accordingly, the Chamber finds untenable the argument of the respondent authorities (autoridades recurridas) of ICAA that they bear no responsibility whatsoever for the problems involving ASADA de El Porvenir. For as long as the water-supply problem continues, the most vulnerable parties are the local residents, who must endure the ineffectiveness of the responsible entities and, consequently, suffer from the deficient provision of the public drinking-water service.

Under that rationale, ICAA must supervise and issue the necessary orders so that ASADA de El Porvenir brings its operations into compliance with the law and the technical studies required to authorize the expenditure of the municipal funds already earmarked to improve the drinking-water supply in that community—and, consequently, the quality of life of all its residents—can be completed.” (Emphasis not in the original).

In addition, section 36, subsection 1), of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales identifies the following as an obligation and right of ICAA: “To execute and terminate delegation agreements for the management of water-supply and sewerage systems with Administrating Associations, when recommended by Management and approved by its Board of Directors, on grounds of advisability, expediency, or ineffectiveness in the provision of public services.”

IV.The specific case. In the sub lite case, the appellant states that he resides in Coto Brus. In this regard, he asserts that residents of Coto Brus and surrounding areas suffer from shortages or a lack of drinking-water supply and have therefore made various requests to the respondent Institute; however, they have not obtained a favorable outcome. He maintains that the respondent authority has the construction plans; however, as of the date this proceeding was filed, it had not completed any stage, notwithstanding the additional fact that funding for construction of the pipeline had been provided by the Asamblea Legislativa.

In this regard, a review of the case record shows that the appellant is a resident of Coto Brus. As to the subject matter of this proceeding, it is apparent that the representatives of the respondent authority acknowledge the existence of the problem reported by the appellant, since they state that the water shortage in the Coto Brus area is caused by leaks in the distribution lines or transmission mains (líneas de conducción), due to the high pressures at which the system must operate to reach the highest areas because of the highly irregular topography where the water-supply system of the Instituto Costarricense de Acueducto y Alcantarillados is located. For this reason, they report under oath that they are implementing the Proyecto de Mejoras al acueducto de Coto Brus (BPIP 2662), which consists of two stages organized as follows: “Stage I: Increased Production of the Coto Brus Water-Supply System.

This stage encompasses the construction of 6 works: spring intakes (captación de nacientes), intake of overflow from the current source, 30km transmission main, implementation of the disinfection system, control and metering, and supplementary works. Stage II: Improvements and expansion of storage capacity, transmission mains, and distribution networks of the Coto Brus Water-Supply System. This stage encompasses communities that currently lack a water supply, such as Villa Roma, Los Pilares, Campo Tres de Agua Buena.” In addition, by way of an update on that project, they state the following: “STAGE I: INCREASED PRODUCTION OF THE COTO BRUS WATER-SUPPLY SYSTEM. PROGRESS ON TRANSMISSION-MAIN DESIGN 60%. PROGRESS ON DESIGN OF THE NEW INTAKE 40%. PROGRESS ON LAND-ACQUISITION PROCEDURES: -12 EASEMENT (SERVIDUMBRE) PLANS, INTAKE-AREA PLAN, PRESSURE-BREAK TANK/CHLORINATOR SITE PLAN. -APPRAISALS ARE BEING PREPARED FOR 3 EASEMENTS. -9 EASEMENT SECTIONS AWAITING SINAC APPROVAL (VISADO).

(APPROVAL REQUESTED BY THE REGISTRO DE LA PROPIEDAD). -THE PRESSURE-BREAK TANK/CHLORINATOR SITE AND INTAKE-AREA PLAN IS BEING REGISTERED THROUGH A POSSESSORY-TITLE PROCEEDING (INFORMACIÓN POSESORIA) AND AWAITS SINAC APPROVAL. -REAL-ESTATE PROCEDURES: CADASTRAL PLANS (PLANOS CATASTRADOS) AND APPRAISALS ARE REQUIRED—THE ADMINISTRATIVE EXPROPRIATION PROCESS IS ESTIMATED TO TAKE APPROXIMATELY 9 MONTHS IF THE OWNERS AGREE. -THE PROJECT HAS AN EMERGENCY DECREE AND CNE CERTIFICATION OF WORKS UNDER THE PLAN GENERAL DE EMERGENCIA (PGE), WHICH IS IMPORTANT FOR CARRYING OUT PROCUREMENT PROCESSES EXPEDITIOUSLY. -PROCEDURES BEFORE SETENA (ENVIRONMENTAL VIABILITY (VIABILIDAD AMBIENTAL)), DIRECCIÓN DE AGUAS, AND SINAC WILL BE CARRIED OUT PURSUANT TO THE EMERGENCY DECREE. (CADASTRAL PLANS ARE REQUIRED TO SUBMIT AN INQUIRY TO SETENA). -APPROXIMATE COST $31,308,722/ ₡18,100,853,513. -AYA IS TAKING STEPS TO OBTAIN FINANCING FOR THE PROJECT. -DELIVERY DATE FOR CONSTRUCTION PLANS AND DETAILED PROJECT BUDGET: FEBRERO 2024.” In view of the foregoing, this Court considers that this proceeding must be granted because, although the respondents reported that they had already begun the Coto Brus water-supply improvement project, it is no less true that they merely provided an estimated date for completing delivery of the construction plans and obtaining the project budget, without identifying a potential schedule containing firm dates and specific actions to resolve the water shortage affecting the community of Coto Brus.

Consequently, there is uncertainty as to the complete conclusion of the project in question. Thus, notwithstanding the respondent institution’s demonstrated efforts to provide a full supply of this vital resource, it has failed to plan timely and sufficient measures to address the problem. Although the problem is undoubtedly highly complex, no mention is made even of preventive measures to provide drinking-water service to the affected population while the corresponding works are carried out. This is so even though the project has an emergency decree and CNE certification of works under the Plan General de Emergencia. These omissions violate the fundamental rights of the protected party and the residents of the protected community and, consequently, the proper course is to grant the proceeding, with the consequences set forth in the operative part (parte dispositiva).

V.Note by Justice Salazar Alvarado. As a matter of principle, I consider that cases involving the inactivity of the Public Administration in the repair, construction, modification, or demolition of any infrastructure work should be dismissed because such an omission concerns a matter of ordinary legality, the adjudication of which falls within the ordinary jurisdiction, where the interested person may challenge the matter more fully. However, when such administrative inaction results in a violation of other fundamental rights protected under this constitutional jurisdiction, or affects groups considered vulnerable, I do address the merits of the matter because such a situation constitutes an exception to my position on this issue, as occurs in this case, in which the appellant alleges that residents of Coto Brus and surrounding areas suffer from shortages or a lack of drinking-water supply and have therefore made various requests to the Instituto Costarricense de Acueductos y Alcantarillados; however, they have not obtained a favorable outcome.

VI. Dissenting opinion (voto salvado) of Justice Garro Vargas concerning enforcement of this judgment

Although I agree with the majority of the Chamber that the proceeding should be granted, I disagree as to the jurisdiction in which the enforcement phase should be conducted, given the absence of adequate mechanisms under the rules governing this constitutional jurisdiction to ensure proper monitoring.

As is well known, pursuant to the Ley de la Jurisdicción Constitucional (LJC), enforcement of the orders issued by the Sala Constitucional must, in principle, be supervised by the Chamber itself. However, art. 56 of the LJC provides for exceptional circumstances in which, as determined by the Chamber itself, enforcement of the judgment is assigned to the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa). The provision in question states:

“Art. 56. Enforcement of judgments falls to the Sala Constitucional, except with respect to the assessment and payment of damages and monetary liabilities, or with respect to other matters that the Chamber itself deems appropriate, in which case enforcement shall take place through contentious-administrative proceedings under the judgment-enforcement procedure established in the law governing that jurisdiction.” (Emphasis not in the original).

It should be recalled that the bill through which the LJC was debated originally provided as follows:

“Art. 56. Judgments favorable to the appellant shall be enforced through contentious-administrative proceedings under the judgment-enforcement procedure established in the law governing that jurisdiction.” (Emphasis not in the original).

However, the text was amended by motion so that the provision would be consistent with art. 153 of the Constitución Política, and the following explanation was given:

“THE SECRETARY:

Motion No. 68 (32-19) by Deputy Chacón Jiménez:

“article 57 (formerly 56): that the text be amended to read as follows: “enforcement of judgments falls to the Sala Constitucional, except with respect to the assessment and payment of damages or monetary liabilities, or other matters that the Chamber itself deems appropriate, in which case enforcement shall take place through contentious-administrative proceedings under the judgment-enforcement procedure established in the law governing that jurisdiction.” THE PRESIDENT:

Dr. Piza Escalante:

Here there was a contradiction with the general thesis that it is the Courts that enforce their judgments, and it referred the entire enforcement proceeding to the Administrative Litigation Jurisdiction; this left the other articles that allowed the Chamber to enforce them without effect.

Deputy Corrales Bolaños:

That part says: “or in other aspects that the Chamber itself considers relevant to the case…,” what does that refer to?

Doctor Piza Escalante:

The idea is that the Chamber, in judgment enforcement proceedings (vía de ejecución de sentencia), should decide whatever it considers to fall within its purview. Everything else is referred to the Administrative Litigation Jurisdiction.

Based on the foregoing, it is clear that the LJC itself authorizes this Chamber to decide what it considers to concern it and may, if it deems appropriate, refer to the Administrative Litigation Jurisdiction those aspects that it determines should be handled there.

In this specific case, the judgment provides as follows:

“Luis Alejandro Guillén Guardia, in his capacity as executive president, and Mario Alexander Villarevia Rivera, in his capacity as cantonal head of the Coto Brus office, both officials of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever respectively holds those offices, are ordered to issue the pertinent instructions and carry out all actions within the scope of their respective authority so that: a) within a maximum period of NINE MONTHS from service of this judgment, the pertinent coordination and actions are undertaken to put the Proyecto de Mejoras al Acueducto de Coto Brus into operation, in order to comprehensively and permanently resolve the water collection and distribution problems in the Acueducto de Coto Brus and guarantee the provision of drinking-water service.” It is evident that the order is extremely complex and that its enforcement can hardly be effectively supervised by this Constitutional Chamber.

By contrast, the provisions of the Code of Administrative Litigation Procedure (Código Procesal Contencioso-Administrativo) concerning enforcement (art. 155 et seq.) offer clear advantages, such as the possibility of requesting schedules, imposing fines, establishing liability, overseeing stages of compliance, and so forth. Therefore, pursuant to article 56 of the LJC, in my view, this judgment must be enforced before the Enforcement Division of the Administrative Litigation and Civil Court for Treasury Matters (Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda), under the judgment-enforcement rules of that Code.

For the foregoing reasons, I dissent with respect to the enforcement of the judgment, which, pursuant to art. 56 of the LJC, must be brought before the Enforcement Division of the Administrative Litigation and Civil Court for Treasury Matters. To that end, I order that a copy of this decision be forwarded so that proceedings to enforce this ruling may be commenced.

VII.Documentation submitted to the case file. The petitioner is hereby advised that, if any paper document was submitted, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must be collected from the court office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.

Por tanto:

The petition is granted. Luis Alejandro Guillén Guardia, in his capacity as executive president, and Mario Alexander Villarevia Rivera, in his capacity as cantonal head of the Coto Brus office, both officials of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever respectively holds those offices, are ordered to issue the pertinent instructions and carry out all actions within the scope of their respective authority so that: a) within a maximum period of NINE MONTHS from service of this judgment, the pertinent coordination and actions are undertaken to put the Proyecto de Mejoras al Acueducto de Coto Brus into operation, in order to comprehensively and permanently resolve the water collection and distribution problems in the Acueducto de Coto Brus and guarantee the provision of drinking-water service; b) IMMEDIATELY upon service of this judgment, the necessary emergency measures are implemented to provide drinking-water service to the population of Coto Brus by means of tanker trucks or another alternative, in order to guarantee access to it while the Proyecto de Mejoras al Acueducto de Coto Brus is being carried out; and c) every THREE MONTHS, they must submit to this Court a progress report on the actions taken to put the Proyecto de Mejoras al Acueducto de Coto Brus into operation.

The foregoing is ordered with the warning that, as established in article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo) that the person must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the legal costs and the damages and losses caused by the facts underlying this declaration, which shall be assessed in administrative-litigation judgment-enforcement proceedings. Justice Salazar Alvarado appends a note. Justice Garro Vargas dissents with respect to the enforcement of this judgment and, pursuant to article 56 of the Ley de la Jurisdicción Constitucional, directs that it be carried out before the Enforcement Division of the Administrative Litigation and Civil Court for Treasury Matters, under the enforcement rules established in articles 155 et seq. of the Code of Administrative Litigation Procedure (Código Procesal Contencioso Administrativo). She further orders that a copy of the judgment be forwarded to that Division so that proceedings to enforce this ruling may be commenced. Let notice be served.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del diecisiete de noviembre de dos mil veintitres .

Recurso de amparo interpuesto por [Nombre62 001], cédula de identidad [CED62 ], contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).

Resultando:

  1. 1Por escrito aportado a la Sala el 3 de octubre de 2023, la parte recurrente interpone recurso de amparo contra el Instituto Costarricense de Acueductos y Alcantarillados. Manifiesta que reside en Coto Brus. Indica que desde hace varios años, los vecinos de Coto Brus y de lugares aledaños sufren de escasez o falta de suministro de agua potable. Alega a largo de todo ese tiempo han realizado diversas gestiones ante el Instituto Costarricense de Acueductos y Alcantarillados, sin resultado positivo. Señala que se logró obtener un crédito para la construcción de la cañería, el cual fue aprobado por la Asamblea Legislativa; sin embargo, no ha sido ejecutado por negligencia del ICAA. Solicita la intervención de este Tribunal Constitucional.
  2. 2Por resolución a las 15:57 horas del 5 de octubre de 2023, se dio curso al presente recurso y se le solicitó informe al presidente ejecutivo y al jefe de la oficina cantonal de Coto Brus, ambos del Instituto Costarricense de Acueductos y Alcantarillados sobre los hechos alegados por la parte recurrente.
  3. 3Por escrito incorporado al expediente electrónico el 11 de octubre de 2023, Mario Alexander Villarevia Rivera, en su condición de jefe cantonal de la oficina de Coto Brus del Instituto Costarricense de Acueductos y Alcantarillados, informa bajo juramento que “Primero: El Instituto Costarricense de Acueducto y Alcantarillados está llevando a cabo el Proyecto de Mejoras al Acueducto de Coto Brus (BPIP 2662). El proyecto Consta de II Etapas: Etapa I: Aumento de Producción del Acueducto de Coto Brus. Esta etapa contempla la construcción de 6 obras: Captación de nacientes, captación de rebalse de fuente actual, línea de conducción 30km, Implementación al sistema de desinfección, Control y medición, y obras complementarias. Etapa II: Mejoras y ampliación en el volumen de almacenamiento, líneas de conducción y redes de distribución del Acueducto de Coto Brus. Esta etapa contempla las comunidades que no cuentan con abastecimiento actualmente como Villa Roma, Los Pilares, Campo Tres de Agua Buena.Segundo: Para llevar a cabo la segunda Etapa, El Instituto Costarricense de Acueductos y Alcantarillados está llevando una Consultoría para determinar las necesidades del Mejoras al Acueducto de Coto Brus mediante la CONTRATACIÓN INTERNACIONAL 2019LI-000012-PRI. Tercero: El objetivo de la consultoría consiste en Garantizar por parte del AyA la sostenibilidad en la prestación del servicio, así como la operación y mantenimiento del acueducto durante el horizonte del proyecto, en aras de preservar la salud de la población en las localidades del área de estudio. Cuarto: Las etapas para el planteamiento de los estudios de factibilidad El Consultor identificará las medidas de inversión a corto, mediano y largo plazo para los sistemas de agua potable, para garantizar el abastecimiento de la población directa e indirecta con un horizonte de vida de 30 años Quinto: Dentro de la generalidad del Acueducto de Coto Brus se tomará el rebalse de la Naciente las Tablas, Construcción de Caseta de Cloración, Incorporación de redes de tuberías de conducción y distribución, válvulas hidráulicas especializadas y mejoras de 5 equipos de bombeo existentes.Así como el aumento en la capacidad de almacenamiento de los tanques: Linda Vista, Copal, Santa Cecilia, San Antonio, Metaponto, La Maravilla, Santa Teresa, Los Ángeles, La Unión, Chisperos y La Lucha. Además de la construcción de un nuevo tanque en Copa Buena del distrito de Agua Buena. Sexto: Para el sistema de Coto Brus se captará agua del rebalse de la naciente Las Tablas y se construirá una tubería adicional desde la naciente Las Tablas hasta la comunidad de Sabalito, con el objetivo de aumentar la resiliencia y la redundancia del acueducto. La cloración se dará después de las nacientes, y el agua será almacenada en los tanques principales los cuales serán ampliados y optimizados. En lo referente a tanques, también se disminuirá la cantidad de pequeños tanques de almacenamiento o tanques quiebragradientes, y se unificarán las zonas de presión y sectores de consumo, con la finalidad de mejorar el comportamiento hidráulico.Esto se complementará con la ubicación de válvulas hidráulicas especializadas para regular los rangos de presiones en el acueducto. Una parte de las redes de tubería de distribución serán incrementadas para mejorar el servicio de agua potable, mejorar la respuesta de los hidrantes, ampliar la cobertura y garantizar la integración de la población proyectada al 2050. Séptimo: Dentro de los trabajos de inmediato se están instalando válvulas de control en los diferentes sectores del sistema. A mediano plazo mejoras de las redes de tubería de conducción, redes de distribución, válvulas de control, tanques de almacenamiento, estaciones de bombeo y obras complementarias. Octavo: El proyecto cuenta con decreto de emergencia y certificación de obras de la CNE del Plan General de Emergencia (PGE). Noveno: Con relación a los faltantes de agua en la zona, se deben a que se presentan fugas en las líneas de distribución o conducción por las altas presiones con que se debe de operar el sistema, para poder llegar a las zonas más altas.Lo anterior por la topografía tan irregular en donde se ubica el acueducto y el Cantón de Coto Brus. Debe señalarse que la oficina en coordinación con la Dirección de la Región Brunca ha realizado grandes esfuerzos en los últimos meses para optar por soluciones remediales previo a la entrada del proyecto ya citado. En relación con este tema, el departamento de ingeniería de la Región, en conjunto con el equipo técnico de la cantonal de Coto Brus, elabora un estudio de diagnóstico, con el objetivo verificar la condición, el comportamiento hidráulico y eventuales oportunidades de mejora asociadas a la operación y optimización del sistema de Coto Brus, con la infraestructura existente. Como parte de las actividades de diagnóstico, el pasado 22 de agosto del presente año, se realizó una gira, a la captación de las tablas, donde participó la Dirección Regional Brunca, Dirección de Agua Potable, Ingeniero de zona y personal operativo de la Cantonal, utilizando equipo de medición (caudalímetros portátiles), donde se realizaron mediciones de caudal en diferentes sectores de la línea de conducción, (Paso Elevado, Clorador) con el objetivo de verificar posibles pérdidas.También en la inspección se identificaron (7) zonas donde se requiere el cambio de las válvulas de aire existentes, este cambio está siendo gestionado con personal técnico de la Cantonal. Aunado a lo anterior se utilizan datos de caudal generados por el caudalímetro, ubicado en el sector puente Sabalito, y se realizan comparaciones con la producción del sistema, lo anterior para verificar de acuerdo con la modelación del sector, el consumo de los servicios existentes para revisión de pérdidas. Se analizan niveles de comportamiento de llenado de tanques, utilizando la plataforma Kolibri, donde se encuentran controles de nivel colocados en los tanques principales del Acueducto, para toma de decisiones en cierres de válvulas, en este punto en particular la Subgerencia de Periféricos, apoyan con la modelación hidráulica de todo el sistema. Cabe resaltar que la Cantonal de San Vito como medida de control de la calidad en la prestación del servicio, realizan monitoreos continuos de las redes de distribución, conducción, fuentes principales y tanques de almacenamiento, así como toma de presiones en diferentes sectores con el fin de identificar averías oportunamente, las 24 horas.Décimo: El personal operativo de la Cantonal de Coto Brus labora con funcionarios disponibles las 24 horas del día, para poder brindar una respuesta rápida y eficiente a las necesidades de nuestros usuarios. Los trabajadores que laboran nos permiten aumentar la capacidad de respuesta y llevar a cabo las reparaciones por averías o fugas necesarias en un plazo reducido, minimizando así el impacto en la calidad del servicio brindado. Undécimo: Cómo parte de la comunicación a la comunidad de Coto Brus, se han realizado reuniones con agrupaciones de la comunidad, Concejo Municipal de Coto Brus y CCCI de Coto Brus. En donde se les ha expuesto los avances del Proyecto “Mejoras del Acueducto de Coto Brus”, con la participación del Personal del AyA a nivel regional, departamento de Programación y Control y Unidad Ejecutora AyA-BCIE”. Solicita que se declare sin lugar el recurso.
  4. 4Por escrito incorporado al expediente electrónico el 11 de octubre de 2023, Luis Alejandro Guillén Guardia, en su condición de presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, informa bajo juramento en el mismo sentido que el jefe cantonal de la oficina de Coto Brus del Instituto Costarricense de Acueductos y Alcantarillados. Solicita que se declare sin lugar el recurso.
  5. 5En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Araya García; y,

Considerando:

I.Objeto del recurso. El recurrente manifiesta que reside en Coto Brus. En ese sentido, afirma que los vecinos de Coto Brus y de lugares aledaños sufren de escasez o falta de suministro de agua potable, por lo que han realizado diversas gestiones ante el Instituto recurrido; sin embargo, no han obtenido un resultado positivo. Sostiene que la autoridad recurrida cuenta con los planos de construcción; sin embargo, a la fecha de interposición de este proceso no ha ejecutado ninguna etapa, con el agravante de que cuentan con un crédito de construcción de la cañería por parte de la Asamblea Legislativa.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

a. El recurrente reside en Coto Brus (hecho incontrovertido); b. El Instituto Costarricense de Acueducto y Alcantarillados está llevando a cabo el Proyecto de Mejoras al acueducto de Coto Brus (BPIP 2662), el cual consta de dos etapas distribuidas de la siguiente manera: “Etapa I: Aumento de Producción del Acueducto de Coto Brus. Esta etapa contempla la construcción de 6 obras: Captación de nacientes, captación de rebalse de fuente actual, línea de conducción 30km, Implementación al sistema de desinfección, Control y medición, y obras complementarias. Etapa II: Mejoras y ampliación en el volumen de almacenamiento, líneas de conducción y redes de distribución del Acueducto de Coto Brus. Esta etapa contempla las comunidades que no cuentan con abastecimiento actualmente como Villa Roma, Los Pilares, Campo Tres de Agua Buena” (ver informe rendido bajo juramento y prueba aportada); c. El Proyecto de Mejoras al acueducto de Coto Brus (BPIP 2662) cuenta con decreto de emergencia y certificación de obras de la CNE del Plan General de Emergencia (ver informe rendido bajo juramento y prueba aportada); d. El Instituto Costarricense de Acueductos y Alcantarillados para llevar a cabo la segunda etapa del Proyecto de Mejoras al Acueducto de Coto Brus (BPIP 2662) está llevando una consultoría mediante la CONTRATACIÓN INTERNACIONAL 2019LI-000012-PRI con la finalidad de garantizar la sostenibilidad de la prestación del servicio de agua, así como la operación y mantenimiento del acueducto con un horizonte de vida de 30 años (ver informe rendido bajo juramento y prueba aportada); e. Dentro de las generalidades del Proyecto de Mejoras al Acueducto de Coto Brus se encuentran las siguientes: rebalse de las nacientes las Tablas, construcción de caseta de cloración, incorporación de redes de tubería de conducción y distribución, válvulas hidráulicas especializadas, mejoramiento de 5 equipos de bombeo existentes, aumento en la capacidad de almacenamiento de los tanques: Linda Vista, Copal, Santa Cecilia, San Antonio, Metaponto, La Maravilla, Santa Teresa, Los Ángeles, La Unión, Chisperos y La Lucha y la construcción de un nuevo tanque en Copa Buena del distrito de Agua Buena (ver informe rendido bajo juramento y prueba aportada); f. La faltante de agua en el sector de Coto Brus se debe a que se presentan fugas en las líneas de distribución o conducción por las altas presiones con que debe operar el sistema para poder llegar a las zonas más altas por la topografía tan irregular en donde se ubica el acueducto del Instituto Costarricense de Acueducto y Alcantarillados (ver informe rendido bajo juramento y prueba aportada); g. El 22 de agosto de 2023, las autoridades del Instituto Costarricense de Acueductos y Alcantarillados realizaron una gira a la captación de las tablas, en la cual participó la Dirección Regional Brunca, Dirección de Agua Potable, ingeniero de zona y personal operativo de la Cantonal, quienes realizaron mediciones de caudal en diferentes sectores de la línea de conducción e identificaron 7 zonas que requieren un cambio de válvulas de aire (ver informe rendido bajo juramento y prueba aportada); h. Las autoridades del Instituto Costarricense de Acueductos y Alcantarillados han expuesto los avances del Proyecto de Mejoras al Acueductos de Coto Brus a la comunidad de Coto Brus (ver informe rendido bajo juramento y prueba aportada); i. El estado actual del proyecto es el siguiente: “I ETAPA: AUMENTO EN LA PRODUCCIÓN DEL ACUEDUCTO DE COTO BRUS.

AVANCE EN DISEÑO DE LA CONDUCCIÓN 60%. AVANCE EN DISEÑO DE LA NUEVA CAPTACIÓN 40%. AVANCE EN GESTIONES PARA ADQUISICIÓN DE TERRENOS: -12 PLANOS DE SERVIDUMBRE, PLANO DE ÁREA DE CAPTACIÓN, PLANO TERRENO TANQUE QUIEBRA GRADIENTE/CLORADOR. -3 SERVIDUMBRES SE ESTÁN CONFECCIONANDO AVALÚOS. -9 TRAMOS DE SERVIDUMBRE EN ESPERA DE VISADO DEL SINAC. (VISADO SOLICITADO POR EL REGISTRO DE LA PROPIEDAD). -PLANO DE TERRENO DE TANQUE QUIEBRA/CLORADOR Y ÁREA DE CAPTACIÓN EN ESTA INSCRIBIENDO POR INFORMACIÓN POSESORIA ESPERA DE VISADO DEL SINAC. -GESTIONES EN BIENES INMUEBLES: SE REQUIEREN PLANOS CATASTRADOS Y AVALÚOS-SE ESTIMA QUE EL TRÁMITE DE EXPROPIACIÓN POR LA VÍA ADMINISTRATIVA DEMORA 9 MESES APROXIMADAMENTE SI LOS PROPIETARIOS ESTÁN DE ACUERDO. -EL PROYECTO CUENTA CON DECRETO DE EMERGENCIA Y CERTIFICACIÓN DE OBRAS DE LA CNE DEL PLAN GENERAL DE EMERGENCIA (PGE), IMPORTANTE PARA REALIZAR PROCESOS DE CONTRATACIÓN DE FORMA EXPEDITA. -GESTIONES SETENA (VIABILIDAD AMBIENTAL), DIRECCIÓN DE AGUAS, SINAC, SE REALIZARÁN LAS GESTIONES AMPARADAS EN EL DECRETO DE EMERGENCIAS.

(SE REQUIEREN LOS PLANOS CATASTRADOS PARA REALIZAR CONSULTA A SETENA). -COSTO APROXIMADO $31,308,722/ ₡18,100,853,513. -AYA SE ENCUENTRA REALIZANDO GESTIONES PARA OBTENER FINANCIAMIENTO DEL PROYECTO. -FECHA DE ENTREGA DE PLANOS CONSTRUCTIVOS Y PRESUPUESTO DETALLADO DE LA OBRA: FEBRERO 2024” (ver informe rendido bajo juramento y prueba aportada).

III.Sobre el derecho al buen funcionamiento de los servicios públicos y el papel del Instituto Costarricense de Acueductos y Alcantarillados como ente rector en materia de abastecimiento de agua potable. Sobre el particular, en la sentencia nro. 2016012058 de las 9:30 horas de 26 de agosto de 2016, esta Cámara indicó:

“(…) en el sub judice se determina que el ICAA, como ente rector en la materia, ha incumplido sus labores de fiscalización y supervisión sobre la prestación del servicio público de agua potable y alcantarillado, y, por tanto, ha violentado los derechos de los recurrentes. Según los artículos 1 y 2 de la Ley Constitutiva del Instituto Costarricense Acueductos y Alcantarillados, el ICAA es responsable, entres otras funciones, de resolver todo lo relacionado con el suministro de agua potable y el servicio de alcantarillado sanitario; de dirigir y vigilar todo lo concerniente para proveer a los habitantes el servicio de agua potable; y de administrar y operar directamente los sistemas de acueductos y alcantarillados en todo el país; por lo cual resulta inexcusable que el ICAA no haya actuado a fin de prevenir y remediar una situación como la presente, en que una ASADA ha venido prestando los servicios supracitados sin suscribir ningún convenio de delegación.

Al efecto, conviene recordar lo que la Sala, en la sentencia Nº 2014-012971 de las 14:45 horas de 8 de agosto de 2014, indicó en relación con el ICAA y sus deberes de fiscalizar y garantizar el debido funcionamiento de los servicios públicos en mención:

“IV.- Sobre el derecho al buen funcionamiento de los servicios públicos y el papel del ICAA como ente rector en materia de abastecimiento de agua. En sentencia número 2012-12009 de las 09:05 horas del 31 de agosto de 2013, esta Sala dispuso lo siguiente, que resulta de interés para la resolución del sub lite:

“Esta Sala ha sostenido que la Constitución Política recoge, implícitamente, el derecho fundamental de los administrados al buen y eficiente funcionamiento de los servicios públicos, esto es: que sean prestados con elevados estándares de calidad. Lo que tiene, como correlato necesario, la obligación de las administraciones públicas de prestarlos de forma continua, regular, célere, eficaz y eficiente. Esta última obligación se desprende de la relación sistemática de varios preceptos constitucionales, tales como el 140, inciso 8 (que impone al Poder Ejecutivo el deber de “Vigilar el buen funcionamiento de los servicios y dependencias administrativas”), el 139, inciso 4 (en cuanto incorpora el concepto de “buena marcha del Gobierno”) y el 191 (en la medida que incorpora el principio de “eficiencia de la administración”). Este Tribunal también ha indicado que dicha garantía individual atípica o innominada se acentúa en tratándose de servicios públicos esenciales como el abastecimiento de agua potable, al estar en juego bienes tan preciados como la salud y la vida humana, por lo que deben imperar con mayor rigor los principios de eficacia, eficiencia, celeridad, continuidad y adaptación (ver, en este sentido, sentencias número 2008-016405 de las 19:04 horas del 30 de octubre de 2008 y 2008-017633 de las 12:06 horas del 5 de diciembre de 2008). En tal contexto adquiere particular trascendencia el papel del Instituto Costarricense de Acueductos y Alcantarillados, como ente rector en la materia. Esta Sala ha señalado que:

“(…) conforme a lo dispuesto en el artículo 1 de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, se ha creado dicha institución autónoma con el expreso objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable. Para cumplir tal objeto, y de conformidad a lo previsto en el artículo 2 de ese mismo cuerpo normativo, al Instituto Costarricense de Acueductos y Alcantarillados le corresponde dirigir y vigilar todo lo concerniente para proveer a los habitantes de la República de un servicio de agua potable , así como aprovechar, utilizar, gobernar o vigilar, según sea el caso, todas las aguas de dominio público indispensables para el debido cumplimiento de las disposiciones de la citada ley. Con lo que se verifica que el Instituto Costarricense de Acueductos y Alcantarillados es el primer llamado en procurar porque todos los habitantes de la República puedan beneficiarse de un sistema de abastecimiento de agua potable, capaz de suministrar dicho líquido de forma continua y en cantidad suficiente para satisfacer debidamente las necesidades básicas de todas las personas, en resguardo efectivo de sus derechos fundamentales a la vida y a la salud” (sentencia número 2011005457 de las 11:32 horas del 29 de abril de 2011.)

En consonancia con lo anterior, esta Sala ha destacado que en aquellos supuestos en que el servicio de suministro de agua para consumo humano lo presta una ASADA, el Instituto Costarricense de Acueductos y Alcantarillados está llamado a ejercer acciones efectivas y eficientes de vigilancia y de control del respectivo sistema de suministro de agua, en cuanto a su operación, mantenimiento, administración y desarrollo, para así garantizar su correcto funcionamiento (sentencia número 2011009487 de las 9:15 horas del 22 de julio de 2011). De hecho, recientemente, en sentencia número 2012006447 de las 10:30 horas del 18 de mayo de 2012, esta Sala expresó:

“(…) si bien el artículo 2 de la Ley 2726 faculta al AyA para convenir con organismos comunales la administración sistemas de acueductos y alcantarillados, el Instituto recurrido, como ente rector en la materia, es el responsable todos los asuntos relativos a la operación, mantenimiento, administración y desarrollo de los sistemas necesarios para el suministro de agua a las poblaciones. A partir de lo anterior, la Administración no puede excusar la inexistencia de un servicio eficiente de agua potable, por la falta de organización comunal o la mala gestión en la administración del acueducto rural por parte del órgano privado concesionado (…)

Con lo que se constata la obligación del Instituto Costarricense de Acueductos y Alcantarillados de fiscalizar y garantizar el debido funcionamiento de los sistemas de acueductos comunales” (lo destacado no corresponde al original) “ V.- Sobre el caso concreto. En la especie, la recurrente alega que en la comunidad de El Porvenir de La Cruz, Guanacaste, el ICAA brinda el servicio de agua potable por delegación en una ASADA; empero, dicho servicio es prestado de manera deficiente y requiere mejoras en la infraestructura, por lo que la Municipalidad de La Cruz asignó una partida para el mejoramiento de dicho acueducto, la cual no puede ejecutarse mientras el ICAA no realice los estudios técnicos correspondientes. Estima vulnerado su derecho fundamental de acceso al agua potable.

Al respecto, la Sala tuvo por acreditado que la Asociación Administradora del Acueducto Rural El Porvenir, La Cruz, Guanacaste, no cuenta con personería jurídica vigente, pues la misma venció desde el 31 de julio de 2007. Asimismo, se aprecia que la ASADA El Porvenir no ha presentado ante el ICAA la documentación requerida para el trámite de firma del convenio de delegación. Además, el ICAA no cuenta con un diagnóstico actualizado del sistema de acueducto operado por la ASADA El Porvenir. De los autos se constató que mediante oficio número SB-GSC-GA-FA-ORAC-CH-2014-1758 del 03 de julio de 2014, la Jefa de la Oficina Regional de Sistemas Comunales de la Región Chorotega del ICAA sugirió a la ASADA El Porvenir que contratara los servicios de un profesional para que realizara un estudio técnico mediante el cual recomendara las mejoras requeridas por el acueducto. Finalmente, se demostró que la Municipalidad de La Cruz asignó una partida de 3 millones de colones para hacer las mejoras a la infraestructura del acueducto, la cual se ejecutará una vez efectuados los estudios técnicos correspondientes.

Ante este panorama, estima la Sala que se debe acoger parcialmente el amparo, solo en contra del ICAA. Tal como se explicó en el considerando anterior, el ICAA está en la obligación de fiscalizar y garantizar el debido funcionamiento de los sistemas de acueductos comunales, de manera que no puede excusarse en que la inexistencia de un servicio eficiente de agua potable responde a la falta de organización comunal o la mala gestión en la administración del acueducto rural. Como ente rector en materia de abastecimiento de agua potable, el ICAA se encuentra llamado a coadyuvar para la pronta solución de la problemática que afecta la comunidad de El Porvenir, en La Cruz de Guanacaste. Así las cosas, para la Sala no es atendible el alegato de las autoridades recurridas del ICAA, en el sentido de que no les corresponde ningún tipo de responsabilidad por los problemas presentados con la ASADA de El Porvenir.

Mientras la problemática en el abastecimiento de agua continúe, la parte más vulnerable son los vecinos de la localidad, quienes deben tolerar la inoperancia de las entidades encargadas y, consecuentemente, sufrir con la deficiente prestación del servicio público de agua potable. Bajo esa inteligencia, deberá el ICAA supervisar y emitir las órdenes necesarias para que la ASADA de El Porvenir ajuste su funcionamiento a derecho y se logren concretar los estudios técnicos necesarios para autorizar la inversión del presupuesto municipal ya destinado para el mejoramiento del abastecimiento de agua potable en esa comunidad y, por ende, de la calidad de vida de todos sus munícipes.”(El destacado no corresponde al original).

En adición, el ordinal 36 inciso 1) del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales, señala como obligación y derecho del ICAA: "Suscribir y rescindir los Convenios de Delegación de la gestión de los sistemas de acueductos y alcantarillados con Asociaciones Administradoras, cuando así lo recomiende la Gerencia y lo apruebe su Junta Directiva, por motivos de conveniencia, oportunidad o ineficacia en la prestación de los servicios públicos".

IV.Sobre el caso concreto. En el sub lite, el recurrente manifiesta que reside en Coto Brus. En ese sentido, afirma que los vecinos de Coto Brus y de lugares aledaños sufren de escasez o falta de suministro de agua potable, por lo que han realizado diversas gestiones ante el Instituto recurrido; sin embargo, no han obtenido un resultado positivo. Sostiene que la autoridad recurrida cuenta con los planos de construcción; sin embargo, a la fecha de interposición de este proceso no ha ejecutado ninguna etapa, con el agravante de que cuentan con un crédito de construcción de la cañería por parte de la Asamblea Legislativa.

Al respecto, del estudio de los autos, se tiene que el recurrente es vecino de Coto Brus. Ahora bien, en relación con el objeto de este recurso, se desprende que los representantes de la autoridad recurrida aceptan la existencia del problema denunciado por el recurrente, toda vez que afirman que la faltante de agua en el sector de Coto Brus se debe a que se presentan fugas en las líneas de distribución o conducción por las altas presiones con que debe operar el sistema para poder llegar a las zonas más altas por la topografía tan irregular en donde se ubica el acueducto del Instituto Costarricense de Acueducto y Alcantarillados. Por tal motivo, informan bajo la solemnidad del juramento que están llevando a cabo el Proyecto de Mejoras al acueducto de Coto Brus (BPIP 2662), el cual consta de dos etapas distribuidas de la siguiente manera: “Etapa I: Aumento de Producción del Acueducto de Coto Brus.

Esta etapa contempla la construcción de 6 obras: Captación de nacientes, captación de rebalse de fuente actual, línea de conducción 30km, Implementación al sistema de desinfección, Control y medición, y obras complementarias. Etapa II: Mejoras y ampliación en el volumen de almacenamiento, líneas de conducción y redes de distribución del Acueducto de Coto Brus. Esta etapa contempla las comunidades que no cuentan con abastecimiento actualmente como Villa Roma, Los Pilares, Campo Tres de Agua Buena”. Aunado a lo anterior, a modo de actualización sobre dicho proyecto señalan lo siguiente: “I ETAPA: AUMENTO EN LA PRODUCCIÓN DEL ACUEDUCTO DE COTO BRUS. AVANCE EN DISEÑO DE LA CONDUCCIÓN 60%. AVANCE EN DISEÑO DE LA NUEVA CAPTACIÓN 40%. AVANCE EN GESTIONES PARA ADQUISICIÓN DE TERRENOS: -12 PLANOS DE SERVIDUMBRE, PLANO DE ÁREA DE CAPTACIÓN, PLANO TERRENO TANQUE QUIEBRA GRADIENTE/CLORADOR. -3 SERVIDUMBRES SE ESTÁN CONFECCIONANDO AVALÚOS. -9 TRAMOS DE SERVIDUMBRE EN ESPERA DE VISADO DEL SINAC.

(VISADO SOLICITADO POR EL REGISTRO DE LA PROPIEDAD). -PLANO DE TERRENO DE TANQUE QUIEBRA/CLORADOR Y ÁREA DE CAPTACIÓN EN ESTA INSCRIBIENDO POR INFORMACIÓN POSESORIA ESPERA DE VISADO DEL SINAC. -GESTIONES EN BIENES INMUEBLES: SE REQUIEREN PLANOS CATASTRADOS Y AVALÚOS-SE ESTIMA QUE EL TRÁMITE DE EXPROPIACIÓN POR LA VÍA ADMINISTRATIVA DEMORA 9 MESES APROXIMADAMENTE SI LOS PROPIETARIOS ESTÁN DE ACUERDO. -EL PROYECTO CUENTA CON DECRETO DE EMERGENCIA Y CERTIFICACIÓN DE OBRAS DE LA CNE DEL PLAN GENERAL DE EMERGENCIA (PGE), IMPORTANTE PARA REALIZAR PROCESOS DE CONTRATACIÓN DE FORMA EXPEDITA. -GESTIONES SETENA (VIABILIDAD AMBIENTAL), DIRECCIÓN DE AGUAS, SINAC, SE REALIZARÁN LAS GESTIONES AMPARADAS EN EL DECRETO DE EMERGENCIAS. (SE REQUIEREN LOS PLANOS CATASTRADOS PARA REALIZAR CONSULTA A SETENA). -COSTO APROXIMADO $31,308,722/ ₡18,100,853,513. -AYA SE ENCUENTRA REALIZANDO GESTIONES PARA OBTENER FINANCIAMIENTO DEL PROYECTO. -FECHA DE ENTREGA DE PLANOS CONSTRUCTIVOS Y PRESUPUESTO DETALLADO DE LA OBRA: FEBRERO 2024”.

En virtud de lo expuesto, este Tribunal considera que este recurso debe estimarse, debido a que si bien los recurridos informaron que ya iniciaron con el proyecto de mejoras del acueducto de Coto Brus, no menos cierto es que únicamente se limitaron a indicar una fecha probable de cuando darán por finalizada la entrega de los planos constructivos y cuando contarán con el presupuesto para la obra, lo anterior sin mencionar un posible cronograma con fechas ciertas y acciones concretas a fin de solventar el problema de desabastecimiento que afecta la comunidad de Coto Brus, por ello, se estima que existe una incertidumbre respecto de la finalización total del proyecto en cuestión. De ahí que, a pesar de los esfuerzos comprobados de la institución recurrida por proveer del preciado líquido de forma íntegra, la falta de previsión de acciones oportunas y suficientes para enfrentar tal problemática, que si bien no se duda es de mucha complejidad, lo cierto es que no se mencionan ni siquiera acciones preventivas para dotar a la población afectada del servicio de agua potable mientras se realizan las obras respectivas.

A pesar de que inclusive dicho proyecto cuenta con decreto de emergencia y certificación de obras de la CNE del Plan General de Emergencia. Dichas omisiones vulneran los derechos fundamentales del amparado y de los vecinos de la comunidad de amparada y, en consecuencia, lo procedente es declarar con lugar el recurso con las consecuencias que se disponen en la parte dispositiva.

V.Nota del magistrado Salazar Alvarado. En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que la parte recurrente acusa que los vecinos de Coto Brus y de lugares aledaños sufren de escasez o falta de suministro de agua potable, por lo que han realizado diversas gestiones ante el Instituto Costarricense de Acueductos y Alcantarillados; sin embargo, no han obtenido un resultado positivo.

VI. Voto salvado de la magistrada Garro Vargas respecto a la ejecución de esta sentencia

Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde corresponde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar un adecuado seguimiento.

Como bien se sabe, de conformidad con la Ley de la Jurisdicción Constitucional (LJC) la ejecución de las órdenes dictadas por la Sala Constitucional corresponde, en principio, ser fiscalizada por la propia Sala. Sin embargo, el art. 56 de la LJC contempla supuestos de excepción en los que, por determinación de la propia Sala, se ordene residenciar la ejecución de la sentencia en la jurisdicción contencioso-administrativa. La norma en cuestión establece lo siguiente:

“Art. 56. La ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones y responsabilidades pecuniarias, o en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción.” (Lo destacado no corresponde al original).

Recuérdese que en el proyecto de ley de discusión de la LJC se preveía originalmente lo siguiente:

“Art. 56. Las sentencias favorables al recurrente se ejecutarán en la vía contencioso-administrativa por el procedimiento de ejecución de sentencia previsto en la ley Reguladora de esa Jurisdicción.” (Lo destacado no corresponde al original).

Sin embargo, el texto fue modificado vía moción para que la norma fuera coincidente con lo regulado en el art. 153 de la Constitución Política, pero se realizó la siguiente explicación:

“EL SECRETARIO:

Moción No. 68 (32-19) del diputado Chacón Jiménez:

“artículo 57 (antes 56): para que el texto se lea así: “la ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones o responsabilidades pecuniarias en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción”.

En discusión la moción leída?

Doctor Piza Escalante:

Aquí había una contradicción con la tesis genérica de que son los Tribunales los que ejecutan sus sentencias y enviaba la Jurisdicción Contencioso Administrativo toda la ejecución; entonces quedaban al aire los otros artículos que le permitían a la Sala ejecutarlos.

Diputado Corrales Bolaños:

En esa parte dice: “o en otros aspectos que la propia Sala considere del aso…”, a qué se está refiriendo?

Doctor Piza Escalante:

La idea es que la Sala, en la vía de ejecución de sentencia, resuelva lo que ella considere que le corresponde. Lo que demás, lo envía a la vía Contencioso Administrativa.

EL SECRETARIO:

Se considera suficientemente discutida la moción?

EL PRESIDENTE:

Discutida. Aprobada (unanimidad, cinco señores diputados presentes).” (Sic. Ver actas de aprobación de la LJC. Lo destacado no corresponde al original).

A partir de lo anterior, está claro que la propia LJC autoriza a esta Sala a que resuelva lo que ella considera que le atañe y podría, de estimarlo así, derivar en la jurisdicción contenciosa administrativa los aspectos que ella valore que así corresponde.

En el caso concreto, la sentencia dispone lo siguiente:

“Se ordena a Luis Alejandro Guillén Guardia, en su condición de presidente ejecutivo, y a Mario Alexander Villarevia Rivera, en su condición de jefe cantonal de la oficina de Coto Brus, ambos funcionarios del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes respectivamente ocupen tales cargos, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus respectivas competencias para que: a) en el plazo máximo de NUEVE MESES, contado a partir de la notificación de esta sentencia, se ejecuten las coordinaciones y acciones pertinentes para que pongan en operación el Proyecto de Mejoras al Acueducto de Coto Brus a efectos de solucionar de manera integral y definitiva los problema de captación y distribución en el Acueducto de Coto Brus para garantizar la prestación del servicio de agua potable”.

Es palmario que lo ordenado reviste extrema complejidad, cuya ejecución difícilmente puede seguirse con eficacia en esta Sala Constitucional. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (art. 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la LJC, a mi juicio, la ejecución de esta sentencia debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

Por lo anterior, salvo el voto respecto de la ejecución de la sentencia, la cual, de conformidad con el art. 56 de la LJC, corresponde ser residenciada en el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda. A tales efectos, ordeno remitir una copia de esta resolución para que se inicien los procedimientos de ejecución de este fallo.

VII.Documentación aportada al expediente. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Luis Alejandro Guillén Guardia, en su condición de presidente ejecutivo, y a Mario Alexander Villarevia Rivera, en su condición de jefe cantonal de la oficina de Coto Brus, ambos funcionarios del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes respectivamente ocupen tales cargos, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus respectivas competencias para que: a) en el plazo máximo de NUEVE MESES, contado a partir de la notificación de esta sentencia, se ejecuten las coordinaciones y acciones pertinentes para que pongan en operación el Proyecto de Mejoras al Acueducto de Coto Brus a efectos de solucionar de manera integral y definitiva los problema de captación y distribución en el Acueducto de Coto Brus para garantizar la prestación del servicio de agua potable; b) de manera INMEDIATA, a partir de la notificación de esta sentencia, se ejecuten las medidas de urgencia necesarias para la dotación del servicio de agua potable a la población de Coto Brus mediante camiones cisterna u otra alternativa para garantizar el acceso a este mientras se lleva a cabo el Proyecto de Mejoras al Acueducto de Coto Brus; y c) deberán remitir a este Tribunal cada TRES MESES, un informe de avance de las acciones llevadas a cabo para poner en operación el Proyecto de Mejoras al Acueducto de Coto Brus.

Lo anterior se dicta con la advertencia de que, según lo establecido por el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Salazar Alvarado pone nota. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
