Findings of Fact (Resultando):

  1. 1By a brief filed with the Office of the Clerk of this Chamber at 13:21 on September 13, 2023, the petitioners filed a constitutional rights action (recurso de amparo) against the MAYOR AND THE HEAD OF THE STORMWATER NETWORK CONSTRUCTION AND MAINTENANCE SECTION, BOTH OF THE MUNICIPALIDAD DE SAN JOSÉ. They state that they are residents of Ciudadela Calderón Muñoz and that, due to the failure of the Municipalidad de San José to carry out the necessary works to prevent the waters of the Río Ocloro from overflowing, on June 26, 2023, they experienced a flood in which the water reached 170 centimeters. They indicate that the force of the water was so great that it tore away gates, doors, and walls, and several residents were even trapped in their homes and vehicles and had to be rescued by firefighters. They add that older adults in the area were unable to leave their homes without assistance and that other individuals suffered panic attacks and consequently had to be assisted.They state that, as a result of the flood, they lost many of their belongings, including vehicles, major household appliances, clothing, and food, and that their homes sustained extensive damage; moreover, outbreaks of illnesses involving symptoms such as diarrhea and vomiting occurred. They allege that the municipality is constructing a retaining wall for the shopping center adjacent to the Río Ocloro to prevent flooding, but that the municipality has taken no action on their behalf. They complain that neither the mayor nor the municipal engineer has visited them to offer a permanent solution to the problem described. They state that their concern is heightened because the rainiest months are August, September, October, November, and December, and they therefore fear that the residential community will flood again. They consider that this situation has caused them psychological harm and violates their fundamental rights. They request that the constitutional rights action be granted and that the respondent authorities be ordered to carry out the necessary works to prevent flooding in Ciudadela Calderón Muñoz.
  2. 2By judgment number PHO7909 issued at nine fifty a.m. on September twelfth, two thousand twenty-three, this Chamber ruled: “VII.- Regarding the application concerning non-enforcement (gestión de inejecución). In the matter at hand (sub lite), the applicants file a subsequent application concerning judgment no. PHO5711 of 9:05 a.m. on June 3, 2016. They allege that, because the Municipalidad de San José failed to carry out the works ordered by this Chamber, on June 26, 2023, they experienced a flood in which the water reached 1.70 centimeters. They indicate that the force of the water was so great that it tore away gates, doors, and walls; several residents were even trapped in their homes and vehicles and had to be rescued by firefighters. They add that older adults in the area were unable to leave their homes without assistance and that other individuals suffered panic attacks and consequently had to be assisted.They state that, as a result of the flood, they lost various belongings, including vehicles, major household appliances, clothing, and food, and that their homes sustained extensive damage; moreover, outbreaks of illnesses involving symptoms such as diarrhea and vomiting occurred. They complain that neither the respondent mayor nor the respondent engineer has visited them to offer a permanent solution to the problem described. They state that their concern is heightened because the rainiest months are August, September, October, November, and December, and they therefore fear that the residential community will flood again. They consider that this situation has caused them psychological harm and violates their fundamental rights. They request that the constitutional rights action be granted and that the respondent authorities be ordered to complete the necessary works to prevent flooding in Ciudadela Calderón Muñoz.In this regard, the Chamber notes that none of the applicants is a party to these proceedings. Notwithstanding the foregoing, they describe a situation involving events that occurred after those adjudicated in the matter at hand. Accordingly, the brief received by the Office of the Clerk of the Chamber on August 9, 2023, shall be severed so that it may be processed as a new matter.   3. 3By an order issued at 15:58 on September 20, 2023, the present constitutional rights action was admitted for processing, and a report was requested from the MAYOR AND THE HEAD OF THE STORMWATER NETWORK CONSTRUCTION AND MAINTENANCE SECTION, BOTH OF THE MUNICIPALIDAD DE SAN JOSÉ (see electronic record).
  4. 4JOHNNY ARAYA MONGE, in his capacity as MAYOR, and MANUEL ORDEÑANA AYERDIS, in his capacity as HEAD OF THE STORMWATER NETWORK CONSTRUCTION AND MAINTENANCE SECTION, both of the MUNICIPALIDAD DE SAN JOSÉ, report under oath (see electronic record) as follows: “FIRST: Eng. Manuel Ordeñana Ayerdis, Head of the Stormwater Network Construction and Maintenance Section, in official letter SCMRP-547-2023, reports the following concerning the subject matter of the dispute: ‘In response to the Constitutional Rights Action filed by Ms. [Nombre317 022] AND OTHER RESIDENTS OF CUIDADELA CALDERÓN MUÑOZ against the Municipalidad de San José, processed under Case No. 23-022400- 0007-CO, and following the order set forth in the brief submitted by the aggrieved parties, the following points are specified: FIRST FACT: True. SECOND FACT: Partially true, because the Municipalidad de San José has carried out work in accordance with the Constitutional Chamber’s requests.THIRD FACT: We agree that the residents were affected by the heavy rainfall. FOURTH FACT: We are aware that the homes were affected. FIFTH FACT: We are aware that the homes were affected. SIXTH FACT: False, because a meeting was held at the Mayor’s Office on August 01 of this year, attended by representatives of the residents together with municipal officials, at which they were heard and were informed how the situation would be addressed. Furthermore, it is clarified that the slope-stabilization work performed adjacent to Clínica Carlos Duran, project #6, is intended to prevent the complete collapse of the properties belonging to the shopping center adjacent to that channel. This stabilization work is necessary so that the proposed channel walls may be constructed safely. SEVENTH FACT: The assertion made is a comment without any technical basis. It should be noted that, from June 26, 2023, to the present, no flooding has been officially recorded in Ciudadela Calderón Muñoz.EIGHTH FACT: We will not comment on these observations. TENTH FACT: We will not comment on this matter. With respect to the foregoing, the following is stated: 1. A total of 10 projects must be carried out, only 7 of which are the responsibility of the Municipalidad de San José; two are the responsibility of private companies, and one is the responsibility of MOPT/ CONAVI, as detailed in the following table:

It is clarified that, of those 10 projects, 7 of which fall within the municipality’s jurisdiction, 3 have been 100% completed, namely projects #2, #4, and #5; project #6 is being carried out by the municipality and will be completed in the I Semester of 2024. Therefore, the projects falling within the municipality’s jurisdiction that remain pending are stages #8, #9, and #10. 2. The work plan for each of the remaining stages (8, 9, and 10) is as follows: ▪ Hydrological study and hydraulic design. This input is already available for all 3 stages, and an update requested by the residents is being prepared.

▪ Construction plans; surveying, soil studies, structural plans, and budget. A budget appropriation is available for this second semester of 2023. ▪ Studies for SETENA. Work will be carried out in 2024. ▪ Permits from the Water Directorate. Work will be carried out in 2024. ▪ Allocation of budget funds by the Municipalidad de San José (budget liquidation). This must be carried out in annual stages. ▪ Public-works tendering process. This must be carried out in annual stages. ▪ Purchase orders and notice to proceed. This must be carried out in annual stages. A schedule is attached, which is tied to the institutional deadlines that we are legally required to observe, including administrative procurement procedures, budget requests submitted to the Contraloría General de la República, and environmental impact assessment (estudio impacto ambiental) procedures processed before SETENA. This environmental procedure is mandatory because the work is carried out in a protected area (área de protección) administered exclusively by the Ministerio de Ambiente, rather than by the Municipalidad de San José. It should be noted that the aforementioned deadlines cannot be omitted; therefore, a table containing realistic estimated timeframes based on the operation of the state apparatus is attached:

Risks attributed to construction: It is clarified to the Constitutional Chamber that this type of work may be carried out only during the dry season (from Enero to Abril). The risks to which we would be exposed if we worked on these projects during the rainy season are listed below: • During the rainy season, the volume of water flowing through the Río Ocloro channel, where we have been asked to work, may reach 50 m3/segundo, which places the workers’ lives in extreme danger. • The work is to be performed at a depth of 4,5 metros, with slopes (taludes) on both sides. It is clarified that the operational personnel will be working at the bottom; the risk of landslides due to water saturation of the soil is real and could affect the workers. A detail of a 5,5 m x 2,5 metros channel, illustrated to scale on the street of Dirección2407, is attached to provide an idea of the impact of this project during its execution. It should be clarified that, to build this channel, practically the entire right-of-way (derecho de vía) must be demolished, all drinking-water, sanitary, electrical, cable, and other utility services must be relocated, and the entire roadway and pavement structure must also be rebuilt.

• Some homes directly adjoin the project because they were built next to the boundary of Río Ocloro; therefore, during the rainy season they would be exposed to impacts from soil saturation, flowing water, and deep excavation at the boundary. In view of the foregoing information, it is clarified that the Municipality is indeed working to find a comprehensive solution to the flooding problem in Río Ocloro. This is in compliance with the order issued in Judgment 2016-007570 of nueve horas cinco minutos del 03 de junio del 2016 by the Constitutional Chamber of the Supreme Court of Justice, processed under Case File 16-005730-0007-CO.” REGARDING THE FACTS STATED: FIRST: As an initial matter, it is important to mention that, from a technical perspective, the problem described by the petitioners is complex; however, these are not new facts but rather a continuation of the problem that was the subject of the amparo proceeding (recurso de amparo) already processed under Case File 16-005730-0007-CO.

As may be seen from the transcribed report and the evidence submitted, this Municipal Corporation has addressed the circumstances and situation described by the petitioners, seeking to develop solutions supported by technical and feasibility reports for the benefit not only of the complainants but also of the public at large. SECOND: That said, based on the petitioners’ allegations and the statements of this Municipality’s technical division, which provides a reasoned response supported by evidence concerning each fact identified by the petitioners in the filing instituting this proceeding, it is evident that the events they describe are regrettable. Nevertheless, this Municipal Corporation is taking, and has already taken, action to prevent their recurrence. Evidence of this is that works #2, #4 and #5 have been completed; work #6 (works explained and described in the tables and schedule mentioned in report scmrp-547-2023) is being carried out by the Municipality and will be completed in the I Semestre del año 2024.

Likewise, the remaining works falling within the jurisdiction of Municipalidad de San José already have an established work plan and an implementation schedule. Nevertheless, it should be noted and clarified that these works cannot be performed during the rainy season, because this type of work may be carried out only during the dry season (from Enero to Abril), given the significant risk not only to municipal workers but also to the homes located near the river due to soil saturation, as explained at length in the technical report transcribed above. THIRD: In addition to the foregoing, it is important to refute the petitioners’ statements, since this Municipal Corporation did conduct a site visit (as indicated in the report transcribed above), attended by neighborhood representatives and municipal officials, during which the residents were heard and the manner in which the situation would be addressed was explained to them.

It is also clarified that there is no preferential treatment for the owners of the shopping center, as the complainants imply. Rather, as described in the tables and work schedules, work # 6 consists of slope-stabilization work (estabilización de ladera) performed next to Clínica Carlos Duran to prevent the complete collapse of the shopping-center properties adjoining that channel. This stabilization work is necessary so that the proposed channel walls can be built under safe conditions. FIFTH: It follows from all the foregoing that this Municipality has taken, and is currently taking, all appropriate action within the Legal System and within the scope of its authority to address the stated problem, in accordance with the procedures and legal framework required to comply with the prior order issued in Judgment 2016-007570 of nueve horas cinco minutos del 03 de junio del 2016 by the Constitutional Chamber of the Supreme Court of Justice, processed under Case File 16-005730-0007-CO.

Therefore, although repetitive, it is necessary to state that it is incorrect to assert that this Municipality regards the residents of the affected area as second-class citizens, that it abandoned them during the events that occurred, or, much less, that it has neither complied with nor carried out the works ordered by the Constitutional Chamber in the case file mentioned above.” It requests that the petition be denied.

Justice Cruz Castro authors the opinion; and,

Considering:

I. SUBJECT MATTER OF THE PETITION

The petitioners—residents of Ciudadela Calderón Muñoz—complain that, because of the failure of Municipalidad de San José to carry out the appropriate works to prevent Río Ocloro from overflowing, on 26 de junio de 2023 they suffered flooding in which the water reached 170 centímetros. They state that the force of the water was so great that it tore away gates, doors, and walls, and that several residents were even trapped in their homes and vehicles and had to be rescued by firefighters. They add that older adults in the area could not leave their homes without assistance and that other persons suffered panic attacks and consequently had to be assisted. They report that, as a result of the flooding, they lost many of their belongings, including vehicles, appliances, clothing, and food, and that the houses sustained extensive damage; outbreaks of illnesses involving symptoms such as diarrhea and vomiting also occurred. They allege that the Municipality is indeed building a retaining wall (muro de retención) for the shopping center adjoining Río Ocloro to prevent flooding, but that the Municipality remains inactive with respect to them. They state that their concern is heightened because the rainiest months are agosto, setiembre, octubre, noviembre and diciembre, and they therefore fear that the residential community will flood again.

II. PROVEN FACTS

The following facts, which are relevant to the disposition of this matter, are deemed duly established, either because they have been proven or because the respondent authority failed to address them as ordered in the initial ruling:

  • a)The petitioners are residents of Ciudadela Calderón Muñoz and, on 26 de junio de 2023, suffered flooding caused by Río Ocloro overflowing, during which the water reached 170 centímetros (see report of the respondent authority).
  • b)On 01 de agosto del año en curso, the residents and the Mayor met to seek a solution to the problem that had occurred (see report of the respondent authority).
  • c)A total of 10 works must be carried out, of which only 7 are the responsibility of Municipalidad de San José, two are the responsibility of private companies, and one is the responsibility of MOPT/ CONAVI (see report of the respondent authority).
  • d)Of the 7 works that are the Municipality’s responsibility, 3 are 100% complete, namely works #2, #4 and #5; work #6 is being carried out by the Municipality and will be completed in the I Semestre del año 2024 (see report of the respondent authority).
  • e)The works that remain entirely pending are stages 8, 9 and 10 (see report of the respondent authority).
  • f)The work plan for each of the remaining stages (8, 9 and 10) is as follows: ▪ Hydrological Study and Hydraulic Design (Estudio Hidrológico y diseño Hidráulico). This input is already available for all 3 stages, and an update requested by the residents is being prepared. Construction plans (planos constructivos); topography, soil studies, structural plans, and budget. A budget allocation is available for this segundo semestre del 2023. ▪ Studies for SETENA. Work will be undertaken in 2024. ▪ Permits from the Water Directorate (Dirección de aguas). Work will be undertaken in 2024. ▪ Budget allocation by Municipalidad de San José (budget settlement (liquidación presupuestaria)). This must be carried out in yearly stages. ▪ Public-works procurement process (proceso de licitación, obra pública). This must be carried out in yearly stages. ▪ Purchase orders and commencement order (órdenes de compra y orden de inicio). This must be carried out in yearly stages (see report of the respondent authority).
  • g)The works to be performed may be carried out only during the dry season (from Enero to Abril) because of the risks posed by the rainy season in this type of work (see report of the respondent authority).

III. PRECEDENT APPLICABLE TO THE SPECIFIC CASE

In judgment number PHO5711 of nueve horas cinco minutos del tres de junio de dos mil dieciséis, this Chamber ruled:

“IV.- Regarding the specific case. A review of the record shows that, on 11 de noviembre de 2015, the petitioner filed 2 complaints concerning the collapse of the sewerage system and the overflow of sewage and garbage in her community, which, according to her statement, caused serious damage to her property on 27 de octubre de 2015 and recurred on 11 de noviembre de 2015. She requested that measures be taken to prevent a future recurrence, that she be informed of what was intended to be done in that regard, and that she be compensated for the damage caused. It must first be explained to the protected party that this Jurisdiction is not responsible for determining whether the administration should be held civilly liable for the alleged damage and required to compensate her. Accordingly, any disagreement with the respondent’s rejection of her claim in that regard is a dispute that must be brought through ordinary legal proceedings (vía de legalidad), should the petitioner see fit to do so. As to the alleged failure to address the stated health and environmental problem and her request in that regard, the merits shall now be decided.

Indeed, the petitioner alleges that, despite the serious consequences of the events of October 2015 caused by the overflowing of the Río Ocloro, the measures required to prevent a similar situation from occurring have not been taken. In this regard, the respondent Municipality emphatically stated, under oath, that the severe flooding that occurred on 27 de octubre de 2015 resulted from an extraordinary rainfall event, during which the Ocloro and María Aguilar rivers, as well as the Pavas and Rivera streams, reached their maximum levels and, in those places where they did not overflow, exceeded the levels of the stormwater system (sistema pluvial) discharge points, preventing the water from flowing through those pipes until after the downpour had ended; this was not caused by the condition of the sewerage system (alcantarillado). They also stated that the Stormwater Network Construction and Maintenance Section worked jointly with the Municipal Disaster Risk Management Office and the Comisión Nacional de Emergencias to formulate a Río Ocloro Watershed Management Program; and they indicated that they were close to tendering a study of the Ocloro micro-watershed (microcuenca), for the purpose of scientifically determining the hydraulic condition of that river and proposing infrastructure works to mitigate flooding.

Nevertheless, with respect to this last matter, although 7 months have elapsed since the flooding that occurred on 27 de octubre de 2015, the respondent Municipality does not even currently refer to an established schedule for verifying the actual capacity of the Río Ocloro containment system in the event of a natural occurrence like the one that already took place. Such verification is essential, as stated by the Governing Health Area, which concluded as follows in report CS-URS-471-2016 of 25 de mayo de 2016:

“4.1. With respect to the verification requested by the Constitutional Chamber as to whether the homes in the area are at risk of flooding due to obstruction by garbage, the answer is that, during intense rainfall, the river can also be expected to carry all types of solid waste found throughout its watershed; this, in turn, increases the risk of obstructions, primarily in those sections where the river is culverted (entubado). In other words, the culverted sections are the most vulnerable to obstructions because of the spatial limitations of their cross-sections, which is not the case in sections where the river has an open channel (cauce abierto). Based on the foregoing, there is a reasonable probability that flooding may occur at the site due to obstructions in the culverted sections. With respect to the subsequent question concerning whether flooding may occur because of deficiencies in the sewerage system or improper disposal of water and channeling of the Río Ocloro, a definitive answer depends on the hydrological and hydraulic studies (estudios hidrológicos e hidráulicos) available to the competent body, in this case the Municipality.

Based on the results of those studies and engineering calculations (memorias de cálculo), it is possible to determine whether the flooding is attributable to constricted areas in the existing drainage cross-sections and/or defects in the design of the stormwater system; it is therefore necessary to review the entire course of the watershed. 4.2. Regarding the Minister’s request to determine and conclude whether the area reported by Ms. [Nombre317 023] poses a danger to the public health of the inhabitants of that sector, the answer is that the river is contaminated with wastewater (aguas residuales), and when that water enters the homes as a result of the river overflowing, it creates an unsanitary condition; therefore, whenever flooding occurs, there will be a genuine danger to the health of local residents. With respect to the recommendations requested by the Minister, this Governing Health Authority advises requesting from the Municipality the respective technical studies, plans, and schedules for the works promised to the community to resolve the flooding problems at issue.” According to the respondent authority’s sworn report, what occurred was an unforeseen extraordinary event.

However, in the case under review (sub examine), as a result of what occurred, at least from October 2015 to the present, the administration knows what may happen if rainfall like that experienced at the time occurs again and, consequently, it is required to take all necessary measures in a timely and responsible manner to mitigate the effects and disasters already known to be capable of recurring—which was a matter of public knowledge and news coverage. The inspection conducted by the Ministerio de Salud also determined the following:

“3.4. -Between the bridge and the area west of the parking lot of the Dos Pinos branch in Bo. Lujan [Dirección1841 ], the river channel was observed to be partially obstructed by organic waste and possibly sediment …Notwithstanding this condition, and in the event that the river overflows at this point, it is the undersigned’s opinion that the event would not affect Ciudadela Calderón Muñoz because the two locations are separated by a distance of approximately 600 m and, moreover, because of the prevailing topography at the site, the overflow can be expected to return to the river channel without traveling more than 100 m. 3.5. -At an approximate distance of 400 m downstream from the reference point indicated in the preceding section stands the CEDESSO building, and it is precisely at this site that a culverted section of the river begins, ending approximately 25 m west of the Multifamiliares de la Ciudadela Calderón Muñoz, which adjoins the eastern sector of Lomas de Ocloro.

The CEDESSO building is located specifically northeast of Clínica Carlos Durán and is the open-channel section of the Río Ocloro closest to Ciudadela Calderón Muñoz, at an approximate distance of 100 m…A perimeter fence was built over the crown of the conduit through which the river flows and along the boundaries of the CEDESSO building property. Evidence could be seen on that fence of organic waste material carried by the river and trapped in the perimeter fence of the building in question, reaching heights of between 1.0 and 1.5 m above the crown of the conduit... This evidence results from an extraordinary flood event (avenida extraordinaria) that, whether or not associated with an obstruction of the culvert, indicates that events of this type, compounded by the proximity and favorable topographic conditions, may cause flooding at Dirección1834 , the complainant’s residence. 3.6.-Based on the visual field inspection conducted today in the area depicted in photograph #1, it was determined that the river also carries wastewater, primarily of a domestic nature.” Accordingly, this Court considers that the petitioner is correct in asserting that sufficient indications exist that the flooding she has experienced may recur because the required measures have not been taken in a timely manner to at least lessen its effects.

It is not enough to state that a micro-watershed study is being planned when its tendering, scheduling, and implementation have not even been finalized. Furthermore, the respondent Ministry also warned of other obstruction problems at the perimeter fence of Dirección1843 that may worsen during heavier rainfall and that must be addressed continuously and promptly by the respondent Municipality. Consequently, the constitutional relief action (amparo) must be granted with respect to this issue.

(…)

Por tanto:

The action is granted. Johnny Araya Monge, in his capacity as Alcalde Municipal de San José, or whoever holds that office, is ordered, within the mandatory period of 6 months counted from service of this judgment, to conduct the studies required to scientifically verify the hydraulic condition of the Río Ocloro and, within the 6 months following that period, to implement the infrastructure works required to prevent flooding at Dirección1833 . The respondent is likewise ordered immediately to adopt all necessary and feasible measures that will help mitigate any flooding that may occur at that location while the studies and works in question are carried out. The respondent must also answer the petitioner and notify her, within no more than 3 business days following service of this ruling, regarding the remainder of the information requested in the applications submitted on 19 de noviembre de 2015, which the respondent did not address in official letter ALCALDIA 00689-2016 of 1 de marzo de 2016.

The respondent authority is advised that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in a constitutional relief proceeding (recurso de amparo) that the person must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The Municipalidad de San José is ordered to pay the legal costs, damages, and losses caused by the events underlying this judgment, which shall be assessed during enforcement proceedings before the contentious-administrative jurisdiction (jurisdicción de lo contencioso administrativo). This decision shall be served personally upon Johnny Araya Monge, in his capacity as Alcalde Municipal de San José, or whoever holds that office. Justice Hernández López dissents and summarily dismisses the action. Justice Jinesta Lobo adds a separate note”.

IV. THE SPECIFIC CASE

The report submitted by the respondent authorities, which was given under the solemnity of an oath and with the legal consequences that this entails, shows that the petitioners are residents of Ciudadela Calderón Muñoz and that, on 26 de junio de 2023, they experienced flooding caused by the overflowing of the Río Ocloro, during which the water reached 170 centímetros. It was established that, on 01 de agosto del año en curso, the residents and the Mayor met to seek a solution to the problem that had occurred. It was demonstrated that a total of 10 works must be carried out, of which only 7 are the responsibility of the Municipalidad de San José, two are the responsibility of private companies, and one is the responsibility of MOPT/ CONAVI. It was verified that, of the 7 works for which the Municipality is responsible, 3 are 100% complete, namely works #2, #4 and #5; work #6 is being performed by the Municipality and will be completed in the I Semestre del año 2024.

It was determined that the works remaining entirely pending are stages 8, 9 and 10. It was stated that the work plan for each of the remaining stages (8, 9 and 10) is as follows: ▪ Hydrological Study and Hydraulic Design. This input is already available for all 3 stages, and work is underway on an update requested by the residents. Construction drawings; topography, soil studies, structural drawings, and budget. A budget appropriation is available for this second semester of 2023. ▪ Studies for SETENA. Work will be carried out in 2024. ▪ Permits from the Dirección de aguas. Work will be carried out in 2024. ▪ Budget allocation by the Municipalidad de San José (budget settlement). This must be carried out in stages each year. ▪ Public-works tendering process. This must be carried out in stages each year. ▪ Purchase orders and notice to proceed. This must be carried out in stages each year.

Finally, it was confirmed that the required works can be performed only during the dry season (época de verano) (de Enero a Abril), because of the risks posed to this type of work by the rainy season (época de invierno).

Based on the foregoing, it is possible to conclude: 1.-) That, due to the heavy rainfall during the rainy season, the residents of Ciudadela Calderón Muñoz suffered damage to their homes and belongings;

  • 2)That the Municipality is responsible for 7 of the 10 projects and that, of those 7, 3 have been fully completed;
  • 3)That project 6 is in the implementation stage, with completion projected for the first half of next year;
  • 4)That projects 8, 9 and 10 remain pending and require: a hydrological study and hydraulic design (work is under way on an update requested by the residents); construction plans (topography, soil studies, structural plans, and budget; a budget appropriation is available for this second half of 2023); studies for SETENA (pending); permits from the Water Directorate (pending); budget allocation by the Municipalidad de San José; and a public-works bidding process. Therefore, notwithstanding the judgment cited in the preceding recital (Considerando), and the extensions of the deadlines for compliance therewith, the problem reported by the residents continues to date. Although the local government has undertaken various actions to implement the infrastructure works required to prevent flooding in the area, the fact remains that the solution has been only partial; worse still, more than six years have passed and local residents continue to experience damage to their homes from the flooding that occurs every year during the rainy season. Accordingly, a violation of the fundamental rights of the petitioners and local residents is evident, and the petition is therefore granted, with the consequences set forth in the operative part of this judgment.

V.Partial dissenting opinion regarding the operative part of this judgment by Justice Garro Vargas. Although I agree with the majority of the Chamber that the petition should be granted, I disagree as to the forum in which the enforcement stage of the matter should be conducted, because the rules governing this constitutional jurisdiction do not provide adequate mechanisms for monitoring a judgment involving highly complex technical aspects, such as the implementation of measures to mitigate flooding in the Ciudadela Calderón Muñoz area and the execution of the necessary infrastructure works to resolve the problem. By contrast, the provisions of the Code of Administrative Litigation Procedure governing enforcement (Article 155 et seq.) offer clear advantages, such as the possibility of requiring schedules, imposing fines, determining liability, overseeing stages of compliance, and so forth. Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement stage should be conducted before the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

This Chamber must advise the petitioner that, if any paper documents, objects, or evidence stored on any additional device or on electronic, computer, magnetic, optical, or telematic media, or produced using new technologies, have been submitted, they must be retrieved from the Court within 30 business days after receipt of notice of this judgment; otherwise, all such materials will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on May 3, 2012, Article LXXXI.

Por tanto:

The petition is granted. JOHNNY ARAYA MONGE, in his capacity as MAYOR, and MANUEL ORDEÑANA AYERDIS, in his capacity as HEAD OF THE STORMWATER NETWORK CONSTRUCTION AND MAINTENANCE SECTION, both of the MUNICIPALIDAD DE SAN JOSÉ, or whoever may hold those offices in their stead, are ordered to immediately take all actions within the scope of their authority to implement all necessary and feasible measures that may help mitigate any flooding that may occur in the Ciudadela Calderón Muñoz area. They must also, within a maximum period of twelve months from notice of this judgment, implement the required infrastructure works and complete the pending stages of the project in order to comprehensively resolve the flooding problem in the Río Ocloro. The foregoing is ordered with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that must be complied with or enforced and who fails to comply with or enforce it shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.

The Municipalidad de San José is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified during enforcement of the judgment in the administrative litigation proceeding. Justice Garro Vargas dissents with respect to the enforcement of this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, directs that it be conducted before the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in Article 155 et seq. of the Code of Administrative Litigation Procedure. She also orders that a copy of the judgment be transmitted to that Division so that proceedings to enforce this ruling may be initiated. Notice shall be given.

Resultando:

  1. 1Por escrito presentado en la Secretaría de esta Sala a las 13:21 horas del 13 de setiembre del 2023 los recurrentes presentan recurso de amparo contra el ALCALDE Y EL JEFE DE LA SECCIÓN DE CONSTRUCCIÓN Y MANTENIMIENTO DE RED PLUVIAL, AMBOS DE LA MUNICIPALIDAD DE SAN JOSÉ. Manifiestan que son vecinos de la Ciudadela Calderón Muñoz y, debido a la inercia de la Municipalidad de San José para ejecutar las obras correspondientes para evitar el desbordamiento de las aguas del Río Ocloro, el 26 de junio de 2023 sufrieron una inundación en la que el agua alcanzó 170 centímetros. Señalan que la fuerza del agua fue de tal magnitud, que arrancó portones, puertas y paredes e incluso, varios vecinos quedaron atrapados en sus casas y vehículos, por lo que debieron ser rescatados por los bomberos. Agregan que las personas adultas mayores de la zona no podían salir de sus casas por sus propios medios y otros sujetos sufrieron ataques de pánico, a causa de lo cual tuvieron que ser auxiliados.Refieren que producto de la inundación perdieron muchos de sus bienes, entre ellos, vehículos, línea blanca, ropa, alimentos y las casas sufrieron fuertes daños; además, se presentaron brotes de enfermedades con síntomas como diarrea y vómito. Acusa que la municipalidad sí le está construyendo un muro de retención al centro comercial contiguo al Río Ocloro, para evitar las inundaciones, pero respecto de ellos, el municipio se mantiene inerte. Reclaman que no han recibido visita alguna por parte del alcalde ni del ingeniero municipal a fin de ofrecerles una solución definitiva al problema expuesto. Manifiestan que su preocupación se agrava, ya que los meses más lluviosos son agosto, setiembre, octubre, noviembre y diciembre, de manera que temen que se vuelva a inundar la ciudadela. Estiman que esta situación les ha generado daños psicológicos y vulnera sus derechos fundamentales. Solicitan que se acoja el recurso de amparo y se ordene a las autoridades recurridas ejecutar las obras pertinentes para evitar inundaciones en la Ciudadela Calderón Muñoz.
  2. 2Por sentencia número PHO7909 de las nueve horas cincuenta minutos del doce de setiembre de dos mil veintitrés esta Sala resolvió: “VII.- Sobre la gestión de inejecución. En el sub lite, los gestionantes plantean gestión posterior en relación con la sentencia nro. PHO5711 de las 9:05 horas de 3 de junio de 2016. Alegan que, debido a que la Municipalidad de San José no ejecutó las obras que ordenó esta Sala, el 26 de junio de 2023 sufrieron una inundación, en la que el agua alcanzó 1.70 centímetros. Señalan que la fuerza del agua fue de tal magnitud, que arrancó portones, puertas y paredes; incluso, varios vecinos quedaron atrapados en sus casas y vehículos, por lo que debieron ser rescatados por los bomberos. Agregan que las personas adultas mayores de la zona no podían salir de sus casas por sus propios medios y otros sujetos sufrieron ataques de pánico, a causa de lo cual tuvieron que ser auxiliados.Refieren que producto de la inundación perdieron varios bienes, entre ellos, vehículos, línea blanca, ropa, alimentos y las casas sufrieron fuertes daños; además, se presentaron brotes de enfermedades con síntomas como diarrea y vómito. Reclaman que no han recibido visita alguna por parte del alcalde ni del ingeniero accionados a fin de ofrecerles una solución definitiva al problema expuesto. Manifiestan que su preocupación se agrava, ya que los meses más lluviosos son agosto, setiembre, octubre, noviembre y diciembre, de manera que temen que se vuelva a inundar la ciudadela. Estiman que esta situación les ha generado daños psicológicos y vulnera sus derechos fundamentales. Solicitan que se acoja el recurso de amparo y se ordene a las autoridades recurridas culminar las obras pertinentes para evitar inundaciones en Ciudadela Calderón Muñoz. Al respecto, la Sala observa que ninguno de los gestionantes es parte en este proceso.Ahora, independientemente de lo anterior, estos describen una situación que contiene hechos posteriores a los resueltos en el sub lite. Por tal motivo, se desglosa el escrito recibido en la Secretaría de la Sala el 9 de agosto de 2023, a fin de que sea tramitado como un asunto nuevo. (…) Por tanto: Desglósese el escrito recibido en la Secretaría de la Sala el 9 de agosto de 2023, a los efectos de que, en los términos del considerando VII de este pronunciamiento in fine, sea tramitado como un asunto nuevo” (ver registro electrónico).
  3. 3Por resolución de las 15:58 horas del 20 de setiembre del 2023 se dio curso al presente amparo y se solicitó informe al ALCALDE Y AL JEFE DE LA SECCIÓN DE CONSTRUCCIÓN Y MANTENIMIENTO DE RED PLUVIAL, AMBOS DE LA MUNICIPALIDAD DE SAN JOSÉ (ver registro electrónico).
  4. 4Informa bajo juramento JOHNNY ARAYA MONGE, en su calidad de ALCALDE y MANUEL ORDEÑANA AYERDIS en su calidad de JEFE DE LA SECCIÓN CONSTRUCCIÓN Y MANTENIMIENTO DE LA RED PLUVIAL, ambos de la MUNICIPALIDAD DE SAN JOSÉ (ver registro electrónico) en los siguientes términos: “PRIMERO: El Ing. Manuel Ordeñana Ayerdis, jefe, Sección Construcción y Mantenimiento de la Red Pluvial, con oficio SCMRP-547-2023, informa con relación al objeto del litigio: “ En atención al Recurso de Amparo interpuesto por la Señora [Nombre317 022] Y OTROS VECINOS DE LA CUIDADELA CALDERÓN MUÑOZ, contra la Municipalidad de San José, tramitado bajo el Expediente No. 23-022400- 0007-CO, según el orden detallado en el escrito presentado por los ofendidos, a continuación, se puntualiza lo siguiente: HECHO PRIMERO: Cierto. HECHO SEGUNDO: Cierto parcialmente, esto debido a que la Municipalidad de San José si ha realizado trabajos en concordancia con lo que la Sala Constitucional ha solicitado HECHO TERCERO: Estamos de acuerdo que si hubo afectaciones a los vecinos por las altas precipitaciones.HECHO CUARTO: Estamos conscientes que hubo afectaciones a las viviendas. HECHO QUINTO: Estamos conscientes que hubo afectaciones a las viviendas. HECHO SEXTO: Falso, debido a que existió una reunión el pasado 01 de agosto del presente año en la Alcaldía Municipal, en donde asistieron representantes de los vecinos en conjunto con funcionarios municipales, en donde se les escucho y se les explico de cómo se va a proceder ante tal situación, por otro lado, se aclara que las labores de estabilización de ladera realizados contiguo a la Clínica Carlos Duran la obra #6 se realizan para evitar el deslizamiento completo de las propiedades del Centro Comercial contiguo a dicho canal, estas obras de estabilización son necesarias para poder ejecutar la construcción de los muros del canal propuesto en condiciones de seguridad. HECHO SÉTIMO: Lo expuesto es un comentario sin base técnica. Cabe destacar que después del 26 de junio del año 2023 al día de hoy no ha existido ninguna inundación registrada oficialmente en la Ciudadela Calderón Muñoz HECHO OCTAVO: Antes estas observaciones no emitiremos comentarios.HECHO DÉCIMO: No emitiremos comentarios al respecto. Ahora bien, en relación con lo anterior se menciona lo siguiente: 1. En total son 10 obras que se deben realizar, de los cuales sólo 7 son responsabilidad de la Municipalidad de San José, dos son responsabilidad de empresas privadas y una es obligación del MOPT/ CONAVI, tal como se detalla en el siguiente cuadro:

Se aclara que esos 10 proyectos de los cuales 7 son competencia municipal, 3 de estos están 100% finalizados los cuales son las obras #2, #4 y #5, la obra #6 se encuentra en ejecución por parte del municipio y se finalizará en el I Semestre del año 2024, por lo tanto, las obras que son competencia municipal y que se encuentran pendientes son las siguientes: etapas #8. #9 y #10. 2. La ruta de trabajos para cada una de las etapas faltantes (8, 9 y 10) es el siguiente ▪ Estudio Hidrológico y diseño Hidráulico. Ya se cuenta con este insumo para las 3 etapas, se trabaja en una actualización solicitada por los vecinos.

▪ Planos constructivos; topografía, estudios de suelo, planos estructurales y presupuesto. Se cuenta con una partida presupuestaria para este segundo semestre del 2023. ▪ Estudios para SETENA. Se trabajará en el 2024. ▪ Permisos de la Dirección de aguas. Se trabajará en el 2024. ▪ Asignación de presupuesto por parte de la Municipalidad de San José (liquidación presupuestaria). Se debe realizar por etapas por año. ▪ Proceso de licitación, obra pública. Se debe realizar por etapas por año. ▪ Órdenes de compra y orden de inicio. Se debe realizar por etapas por año. Se adjunta cronograma el cual está vinculado a los plazos institucionales que debemos respetar por ley, entre ellos, los procesos de contratación administrativa, las solicitudes presupuestarias ante la Contraloría General de la República, los procedimientos de estudio impacto ambiental que se tramitan ante SETENA, este trámite ambiental es obligatorio debido a que las obras se realizan en un área de protección cuya administración es exclusiva del Ministerio de Ambiente y no por la Municipalidad de San José, cabe destacar que lo anteriormente mencionado son plazos que no se pueden omitir, razón por la cual, se adjunta tabla con plazos estimados realistas en relación con el funcionamiento del aparato estatal:

Riesgos atribuidos a la construcción: Se le aclara a la sala constitucional que este tipo de obras sólo pueden ser ejecutadas durante la época de verano (de Enero a Abril), a continuación, se mencionan los riesgos a los que nos exponemos si trabajamos en estos proyectos durante el Invierno: • Durante la época de invierno el volumen de agua que pasa por el cauce del Río Ocloro, donde se nos solicita trabajar, puede llegar a los 50 m3/segundo, lo cual expone de manera sumamente peligrosa la vida de los trabajadores. • La profundidad del trabajo a realizar es de 4,5 metros de profundidad con taludes a ambos lados, se aclara que el personal operativo estará en la parte inferior laborando, el riesgo a deslizamientos por saturación de agua de los suelos es real y podría afectar a los trabajadores. Se adjunta detalle de canal de 5,5 m x 2,5 metros ejemplificado a escala en la calle del Dirección2407 , para dar una idea del impacto de este proyecto durante la ejecución. Cabe aclarar; que para construir este canal se debe demoler prácticamente todo el derecho de vía, relocalizar todos los servicios de agua potable, sanitarios, luz, servicios de cablería entre otros, además de reconstruir toda la vía y estructura de pavimento.

• Algunas viviendas colindan directamente con el proyecto, esto por la construcción contigua al límite del Río Ocloro por lo tanto; en época de invierno se expondrían a ser afectadas por saturación de suelos, el paso del agua y la excavación profunda al límite. En vista a los anteriores datos se aclara que el Municipio sí está laborando en buscar la solución de manera integral de la problemática de inundaciones en el Río Ocloro. Lo anterior en cumplimiento a lo ordenado en Sentencia 2016-007570 de las nueve horas cinco minutos del 03 de junio del 2016, emitido por la Sala Constitucional de la Corte Suprema de Justicia, que se tramita mediante el Expediente 16-005730-0007-CO.” EN RELACIÓN CON LOS HECHOS MANIFESTADOS PRIMERO: En primera instancia, es importante mencionar que desde una perspectiva técnica la problemática que expone el recurrente es un asunto complejo, pero no son hechos nuevos, sino que vienen siendo continuidad a la problemática objeto del recurso de amparo tramitado ya mediante el expediente 16-005730-0007-CO, hechos de los cuales como se puede observar en el informe trascrito y de la prueba que se aporta, esta Corporación Municipal ha abarcado los aspectos y la situación expuesta por el recurrente buscando generar soluciones respaldades en informes técnicos y de conveniencia no solo para beneficio de los denunciantes, sino para la ciudadanía en general.

SEGUNDO: Ahora bien, partiendo de lo denunciado por los recurrentes, así como de lo manifestado por la parte técnica de esta Municipalidad, la cual le brinda una respuesta fundamentada y con las pruebas de cada uno de los hechos señalados en el escrito de interposición del presente recurso por los recurrentes, se evidencia que lo descrito por ellos, son hechos lamentables, pero de los cuales esta Corporación Municipal se encuentra realizando y ya ha realizado acciones para evitar que se repitan, prueba de ellos es que se han realizado las obras #2, #4 y #5, la obra #6 (obras explicadas y descritas en los cuadros y cronograma mencionados en el informe scmrp-547-2023) se encuentra en ejecución por parte del municipio y se finalizará en el I Semestre del año 2024. Asimismo, las demás obras que son competencia de la Municipalidad de San José, ya tienen una ruta definida de trabajo y cuentan con un cronograma de acción para ejecutarlas.

No obstante, cabe mencionar y aclarar, que dichas obras no pueden realizarse en época de invierno ya que este tipo de obras sólo pueden ser ejecutadas durante la época de verano (de Enero a Abril), siendo que existe un gran riesgo no solo para los trabajadores municipales, sino también del riesgo que existe en las viviendas que se encuentran cercanas al río, debido a la saturación de los suelos, tal como se explica ampliamente en el informe técnico trascrito supra. TERCERO: Aunado a lo anterior, es importante desvirtuar lo manifestado por los accionantes toda vez, que esta Corporación Municipal sí ha realizado una visita al lugar de los hechos, (tal como se indica en el informe trascrito líneas arriba), en donde asistieron representantes de los vecinos en conjunto con funcionarios municipales, en donde se les escucho y se les explico de cómo se va a proceder ante tal situación. Además, se aclara que no es que se tenga preferencia con los dueños del centro comercial, como lo dejan ver los reclamantes, sino que tal como se describe en los cuadros y cronogramas de trabajo la obra # 6, corresponde a las labores de estabilización de ladera realizados contiguo a la Clínica Carlos Duran, la cuales se realizan para evitar el deslizamiento completo de las propiedades del Centro Comercial contiguo a dicho canal, estas obras de estabilización son necesarias para poder ejecutar la construcción de los muros del canal propuesto en condiciones de seguridad.

QUINTO: De todo lo anterior, se puede desprender que esta Municipalidad ha realizado y se encuentra a la fecha realizando todas las acciones pertinentes dentro del Ordenamiento Jurídico y dentro de su ámbito competencial, para la atención de problemática indicada, acatando los procedimientos y marco de legalidad para cumplir con lo ya ordenado en Sentencia 2016-007570 de las nueve horas cinco minutos del 03 de junio del 2016, emitido por la Sala Constitucional de la Corte Suprema de Justicia, que se tramita mediante el Expediente 16-005730-0007-CO. Por lo que resulta reiterativo, pero necesario indicar; que no es correcto afirmar que este Municipio considere a los habitantes de la zona afectada como habitantes de segunda, ni que los haya dejado abandonados durante los hechos ocurridos, ni mucho menos señalar que no se ha acatado, ni realizado las obras ordenadas por la Sala Constitucional en el expediente mencionado supra”. Solicita que se declare sin lugar el recurso.

  1. 5En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I. OBJETO DEL RECURSO

Los recurrentes -vecinos de la Ciudadela Calderón Muñoz- reclaman que, debido a la inercia de la Municipalidad de San José para ejecutar las obras correspondientes para evitar el desbordamiento de las aguas del Río Ocloro, el 26 de junio de 2023 sufrieron una inundación en la que el agua alcanzó 170 centímetros. Señalan que la fuerza del agua fue de tal magnitud, que arrancó portones, puertas y paredes e incluso, varios vecinos quedaron atrapados en sus casas y vehículos, por lo que debieron ser rescatados por los bomberos. Agregan que las personas adultas mayores de la zona no podían salir de sus casas por sus propios medios y otros sujetos sufrieron ataques de pánico, a causa de lo cual tuvieron que ser auxiliados. Refieren que producto de la inundación perdieron muchos de sus bienes, entre ellos, vehículos, línea blanca, ropa, alimentos y las casas sufrieron fuertes daños; además, se presentaron brotes de enfermedades con síntomas como diarrea y vómito. Acusa que la municipalidad sí le está construyendo un muro de retención al centro comercial contiguo al Río Ocloro, para evitar las inundaciones, pero respecto de ellos, el municipio se mantiene inerte. Manifiestan que su preocupación se agrava, ya que los meses más lluviosos son agosto, setiembre, octubre, noviembre y diciembre, de manera que temen que se vuelva a inundar la ciudadela.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

  • a)Que los recurrentes son vecinos de la Ciudadela Calderón Muñoz y, el 26 de junio de 2023 por el desbordamiento de las aguas del Río Ocloro sufrieron una inundación en la que el agua alcanzó 170 centímetros (ver informe de la autoridad recurrida).
  • b)Que el 01 de agosto del año en curso los vecinos y el Alcalde se reunieron para buscar una solución a la problemática acaecida (ver informe de la autoridad recurrida).
  • c)Que en total son 10 obras que se deben realizar, de los cuales sólo 7 son responsabilidad de la Municipalidad de San José, dos son responsabilidad de empresas privadas y una es obligación del MOPT/ CONAVI (ver informe de la autoridad recurrida).
  • d)Que de las 7 obras que son responsabilidad de la Municipalidad 3 de estos están 100% finalizados los cuales son las obras #2, #4 y #5, la obra #6 se encuentra en ejecución por parte del municipio y se finalizará en el I Semestre del año 2024 (ver informe de la autoridad recurrida).
  • e)Que las obras que se encuentran pendientes en su totalidad con las etapas 8, 9 y 10 (ver informe de la autoridad recurrida).
  • f)Que la ruta de trabajos para cada una de las etapas faltantes (8, 9 y 10) es el siguiente ▪ Estudio Hidrológico y diseño Hidráulico. Ya se cuenta con este insumo para las 3 etapas, se trabaja en una actualización solicitada por los vecinos. Planos constructivos; topografía, estudios de suelo, planos estructurales y presupuesto. Se cuenta con una partida presupuestaria para este segundo semestre del 2023. ▪ Estudios para SETENA. Se trabajará en el 2024. ▪ Permisos de la Dirección de aguas. Se trabajará en el 2024. ▪ Asignación de presupuesto por parte de la Municipalidad de San José (liquidación presupuestaria). Se debe realizar por etapas por año. ▪ Proceso de licitación, obra pública. Se debe realizar por etapas por año. ▪ Órdenes de compra y orden de inicio. Se debe realizar por etapas por año (ver informe de la autoridad recurrida).
  • g)Que las obras que se deben realizar únicamente pueden ser ejecutadas durante la época de verano (de Enero a Abril) por los riesgos que genera en ese tipo de trabajos la época de invierno (ver informe de la autoridad recurrida).

III. ANTECEDENTE DE APLICACIÓN AL CASO CONCRETO

Esta Sala mediante sentencia número PHO5711 de las nueve horas cinco minutos del tres de junio de dos mil dieciséis resolvió:

“IV.- Sobre el caso concreto. Del estudio de los autos, se tiene que el pasado 11 de noviembre de 2015, la recurrente planteó 2 reclamos en relación con el colapso del sistema de alcantarillado y desbordamiento de aguas negras y basura en su comunidad, que según indicó, le produjo graves daños en su propiedad el 27 de octubre de 2015, y que se repitió el 11 de noviembre de 2015; pidió que se tomaran medidas para evitar lo sucedido a futuro, que se le informara de lo que se pretendía realizar al respecto, y que se le indemnizara por los daños producidos. Debe indicarse de previo a la amparada, que no le corresponde a esta Jurisdicción determinar si la administración debe ser tenida como responsable civil de los daños atribuidos e indemnizar a la amparada, por lo que la eventual disconformidad con el rechazo de su reclamo en tal sentido por parte de la recurrida, es una discusión que corresponde ser planteada en la vía de legalidad, si así lo tiene a bien la recurrente. En cuanto a la acusada falta de atención al problema de salud y ambiental referido, y de su gestión en este sentido, se procede a resolver por el fondo.

En efecto, la recurrente acusa que a pesar de las graves secuelas de lo ocurrido en octubre de 2015 por el desbordamiento del Río Ocloro, no se han tomado las medidas requeridas para evitar que ocurra una situación similar. Al respecto, la Municipalidad recurrida fue enfática en señalar, bajo fe de juramento, que las graves inundaciones producidas el 27 de octubre de 2015, fueron producto de un evento extraordinario de lluvia, en el que los ríos Ocloro y María Aguilar, así como las quebradas Pavas y Rivera, alcanzaron su máximo nivel y en aquellos lugares donde no se desbordaron, superaron los niveles de los puntos de descarga del sistema pluvial, lo que provocó que el agua no fluyera por dichas tuberías, sino pasado el aguacero; lo cual no fue producto de la condición del alcantarillado. Asimismo, señalaron que la Sección Construcción y Mantenimiento de la Red Pluvial trabajó en conjunto con la Oficina de Gestión Municipal de Riesgo a Desastres y la Comisión Nacional de Emergencias para formular un programa de Atención de la Cuenca del río Ocloro; e indican estar prontos a licitar un estudio de la microcuenca del Ocloro, con el fin de determinar científicamente la condición hidráulica de ese río y proponer obras de infraestructura que mitigaran las inundaciones.

No obstante, sobre este último aspecto, a pesar de que han transcurrido 7 meses desde la inundación ocurrida el 27 de octubre de 2015, la Municipalidad recurrida ni siquiera hace alusión actualmente a un cronograma ya establecido para verificar la situación real de la contención del Río Ocloro ante un eventual hecho natural como el que ya se produjo, lo cual es primordial según con lo señalado por el Área Rectora de Salud, quien en el informe CS-URS-471-2016 del 25 de mayo de 2016 concluyó:

“4.1. Con relación a la verificación que solicita la Sala Constitucional en cuanto a si las viviendas del sector corren algún peligro de inundación por obstrucción de basuras. La respuesta es que durante la ocurrencia de precipitaciones intensas, es de esperar que el río también arrastre todo tipo de residuos sólidos que se encuentre a lo largo de su cuenca: lo cual a su vez, incrementa el riesgo de que se presenten obstrucciones principalmente en los sectores en que el río se encuentra entubado; es decir, los sectores entubados son los más vulnerables a obstrucciones en razón de las limitaciones de espacio en sus secciones, lo cual no ocurre con los sectores del río con cauce abierto: con base en lo dicho, existe una razonable probabilidad de ocurrencia de inundaciones en el sitio por obstrucciones en los sectores entubados. Con relación a la siguiente consulta de que ocurran inundaciones por deficiencias en el alcantarillado o mala disposición de las aguas y canalización del río Ocloro; una respuesta certera a esta consulta está en función de estudios hidrológicos e hidráulicos con que cuente el órgano competente, en este caso la Municipalidad.

A partir de los resultados de estos estudios y memorias de cálculo es posible definir si la ocurrencia de las inundaciones obedece a la existencia de áreas reducidas en las secciones de evacuación existente y/o a defectos en el diseño del sistema pluvial, por lo que es necesario revisar todo el trayecto de la cuenca. 4.2. En cuanto a la solicitud de la señora Ministra en el sentido de llegar a determinar y concluir si el área denunciada por la señora [Nombre317 023], representa un peligro para la salud pública de los habitantes de ese sector. La respuesta es que el río se encuentra contaminado con aguas residuales y al llegar estas aguas al interior de las viviendas producto de un desbordamiento del río se va a generar una condición insalubre, por lo que cada vez que ocurra una inundación va a existir un peligro real para la salud de los residentes del lugar. Con relación a las recomendaciones que solicita la señora Ministra.

Esta Rectoría aconseja solicitarle a la Municipalidad los respectivos estudios técnicos, planes y cronogramas de actividades de obras que le han prometido a la comunidad para resolver los problemas de inundaciones que nos ocupan.” Según informó bajo juramento la autoridad recurrida, lo ocurrido fue un evento extraordinario no previsto. Sin embargo, en el sub examine, a partir de lo sucedido, al menos de octubre de 2015 a la fecha, la administración sabe lo que puede llegar a ocurrir de volver a tener precipitaciones como las de entonces, y en consecuencia, está obligada a tomar oportuna y responsablemente todas las medidas necesarias, a fin mitigar los efectos y desastres que ya se conoce pueden llegar a ocurrir de nuevo –lo cual fue un hecho público y noticioso-. En la inspección realizada por el Ministerio de Salud, también se determinó lo siguiente:

“3.4. -Entre el puente y el sector Oeste del estacionamiento de la sucursal de la Dos Pinos en Bo. Lujan [Dirección1841 ] se pudo observar el cauce del río parcialmente obstruido con desechos orgánicos y posiblemente con sedimentos …No obstante esta condición y en el caso de que ocurra un desbordamiento en este punto, es criterio del suscrito que el evento no afectaría a la Ciudadela Calderón Muñoz, en razón de que entre ambos sitios existe una distancia de separación de unos 600 m y por otro lado, por la topografía imperante en el sitio, es de esperar que el desbordamiento regrese al cauce del rio sin recorrer más de 100 m. 3.5. -A una distancia aproximada de unos 400 m aguas abajo respecto al punto de referencia indicado en la sección anterior, se encuentra el edificio CEDESSO y justamente en este sitio se inicia un tramo entubado del río que termina a unos 25 m al Oeste de los Multifamiliares de la Ciudadela Calderón Muñoz, la cual colinda con el sector Este de Lomas de Ocloro.

El edificio CEDESSO se ubica específicamente al Noreste de la Clínica Carlos Durán y es el sector del cauce abierto del río Ocloro más cercano a la Ciudadela Calderón Muñoz, encontrándose a una distancia aproximada de 100 m…Sobre la corona del ducto por donde fluye el río y en los linderos de la propiedad del edificio CEDESSO se construyó una malla perimetral en la cual se pudo apreciar la evidencia de material de desecho orgánico transportado por el río que quedó atrapado en la malla perimetral del edificio en cuestión, alcanzando alturas entre 1.0 y 1.5 m sobre la corona del ducto... Dicha evidencia es el resultado de la ocurrencia de una avenida extraordinaria que probablemente asociada o no con alguna obstrucción del entubamiento es posible que este tipo de eventos coadyuvados por la cercanía y condiciones topográficas favorables lleguen a causar inundaciones a la Dirección1834 , sitio de residencia de la denunciante. 3.6.-Fundamentado en la inspección visual de campo realizada en este día en la zona descrita en la fotografía #1 se pudo determinar que el río también transporta aguas residuales del tipo doméstico en su mayor parte.” Así las cosas, considera este Tribunal que lleva razón la recurrente en señalar, que existen suficientes indicios de que puedan volver a ocurrir las inundaciones de las que ha sido objeto, por no atenderse de forma oportuna lo requerido, para al menos aminorar sus efectos.

No basta con indicar que se está programando realizar un estudio de la microcuenca, si ni siquiera se ha concretado su licitación, programación y ejecución. Por otro lado, el Ministerio recurrido también advirtió otros problemas de obstaculización en la malla perimetral del Dirección1843 que pueden agravarse ante precipitaciones mayores, y que deben ser atendidos constante y oportunamente por la Municipalidad recurrida. Por consiguiente, el amparo debe ser declarado con lugar en cuanto a este extremo se refiere.

(…)

Por tanto:

Se declara con lugar el recurso. Se ordena a Johnny Araya Monge, en su condición de Alcalde Municipal de San José, o a quien ocupe el cargo, que proceda en el plazo improrrogable de 6 meses contado a partir de la notificación de esta sentencia, a realizar los estudios que se requieran para verificar científicamente la condición hidráulica del Río Ocloro, y en los 6 meses siguientes a dicho plazo, implementar las obras de infraestructura que se requieran para evitar las inundaciones en el Dirección1833 . Asimismo, se ordena al recurrido adoptar de inmediato todas las medidas necesarias y posibles que coadyuven a mitigar las inundaciones que puedan producirse en dicho lugar, mientras se realizan los estudios y las obras en cuestión; así como también, deberá contestar y notificar a la recurrente, en un plazo no mayor a 3 días hábiles a partir de la notificación de este pronunciamiento, el resto de la información solicitada en las gestiones planteadas el 19 de noviembre de 2015, que no fueron atendidas por el recurrido en el oficio ALCALDIA 00689-2016 del 1 de marzo de 2016.

Se advierte a la autoridad recurrida, que de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San José al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese esta resolución a Johnny Araya Monge, en su condición de Alcalde Municipal de San José, o a quien ocupe el cargo, en forma personal. La Magistrada Hernández López salva el voto y rechaza de plano el recurso. El Magistrado Jinesta Lobo pone nota”.

IV. SOBRE EL CASO CONCRETO

Del informe rendido por las autoridades recurridas el cual es dado bajo la solemnidad del juramento con las consecuencias legales que ello implica se desprende que los recurrentes son vecinos de la Ciudadela Calderón Muñoz y, el 26 de junio de 2023 por el desbordamiento de las aguas del Río Ocloro sufrieron una inundación en la que el agua alcanzó 170 centímetros. Se acreditó que el 01 de agosto del año en curso los vecinos y el Alcalde se reunieron para buscar una solución a la problemática acaecida. Se demostró que en total son 10 obras que se deben realizar, de los cuales sólo 7 son responsabilidad de la Municipalidad de San José, dos son responsabilidad de empresas privadas y una es obligación del MOPT/ CONAVI. Se verificó que de las 7 obras que son responsabilidad de la Municipalidad 3 de estos están 100% finalizados los cuales son las obras #2, #4 y #5, la obra #6 se encuentra en ejecución por parte del municipio y se finalizará en el I Semestre del año 2024.

Se determinó que las obras que se encuentran pendientes en su totalidad con las etapas 8, 9 y 10. Se afirmó que la ruta de trabajos para cada una de las etapas faltantes (8, 9 y 10) es el siguiente ▪ Estudio Hidrológico y diseño Hidráulico. Ya se cuenta con este insumo para las 3 etapas, se trabaja en una actualización solicitada por los vecinos. Planos constructivos; topografía, estudios de suelo, planos estructurales y presupuesto. Se cuenta con una partida presupuestaria para este segundo semestre del 2023. ▪ Estudios para SETENA. Se trabajará en el 2024. ▪ Permisos de la Dirección de aguas. Se trabajará en el 2024. ▪ Asignación de presupuesto por parte de la Municipalidad de San José (liquidación presupuestaria). Se debe realizar por etapas por año. ▪ Proceso de licitación, obra pública. Se debe realizar por etapas por año. ▪ Órdenes de compra y orden de inicio. Se debe realizar por etapas por año.

Finalmente se constató que las obras que se deben realizar únicamente pueden ser ejecutadas durante la época de verano (de Enero a Abril) por los riesgos que genera en ese tipo de trabajos la época de invierno.

Partiendo de lo anterior es posible concluir: 1.-) Que por las altas precipitaciones presentadas durante la época lluviosa los vecinos de la Ciudadela Calderón Muñoz vieron afectas sus viviendas y pertenencias;

  • 2)Que la Municipalidad es responsable de 7 de los 10 proyectos y que, de esos 7 3 están completamente finalizados;
  • 3)Que la obra 6 se encuentra en etapa de ejecución con una proyección de culminación para el primer semestre del año próximo;
  • 4)Que las obras 8, 9 y 10 se encuentran pendientes y requieren: Estudio Hidrológico y diseño Hidráulico (se trabaja en una actualización solicitada por los vecinos); Planos constructivos (topografía, estudios de suelo, planos estructurales y presupuesto. Se cuenta con una partida presupuestaria para este segundo semestre del 2023); Estudios para SETENA (pendiente); Permisos de la Dirección de aguas (Pendiente); Asignación de presupuesto por parte de la Municipalidad de San José; Proceso de licitación, obra pública. Por lo tanto y pese a la sentencia citada en el Considerando anterior, y las prórrogas de plazos para el cumplimiento de la misma a la fecha continua la problemática denunciada por los vecinos. Si bien es cierto el gobierno local ha realizado varias gestiones para implementar las obras de infraestructura que se requieran para evitar las inundaciones en el sector lo cierto es que la solución ha sido parcial; peor aún han transcurrido más de seis años y los vecinos del lugar continúan enfrentando las afectaciones en sus viviendas por las inundaciones de todos los años en la época lluviosa. Así las cosas se denota una violación a los derechos fundamentales de los recurrentes y los vecinos del lugar por lo que se declara con lugar el recurso con las consecuencias que se indican en la parte dispositiva de esta sentencia.

V.Voto salvado parcial respecto a la parte dispositiva de esta sentencia de la magistrada Garro Vargas. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como lo es la implementación de medidas para mitigar las inundaciones en el sector Ciudadela Calderón Muñoz y llevar a cabo las obras de infraestructura necesarias, a fin de resolver la problemática. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a JOHNNY ARAYA MONGE, en su calidad de ALCALDE y MANUEL ORDEÑANA AYERDIS en su calidad de JEFE DE LA SECCIÓN CONSTRUCCIÓN Y MANTENIMIENTO DE LA RED PLUVIAL, ambos de la MUNICIPALIDAD DE SAN JOSÉ o a quienes en su lugar ocupen los cargos que de inmediato adopten todas las actuaciones que se encuentren dentro de su ámbito de competencia, para implementar todas las medidas necesarias y posibles que coadyuven a mitigar las inundaciones que puedan producirse en el sector Ciudadela Calderón Muñoz. Deberán además en el plazo máximo de doce meses contados a partir de la notificación de esta sentencia implementar las obras de infraestructura que se requieran y culminar las etapas pendientes del proyecto a fin de resolver de manera integral de la problemática de inundaciones en el Río Ocloro. Lo anterior, bajo el apercibimiento de que, con base en lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de San José al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
