Document Review Res. Nº PHO7951 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nueve horas veintisiete minutos on seis de octubre de dos mil veintitres.
Amparo petition (recurso de amparo) filed by [Nombre317 001], identity card [CED168 ], on behalf of [...], legal entity identification number [Valor CED185], against EL MINISTERIO DEL AMBIENTE Y ENERGÍA (MINAE) and EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADO (ICAA).
BACKGROUND:
If there is an operator within the indicated radius that has stated in writing that it lacks the capacity to take over the new aqueduct or the community to be supplied, AyA shall conduct a technical study to determine the current situation of the ASADA in light of that demand and possible solutions, within a maximum period of three months.” It should be reiterated that the evidence submitted by the appellant shows that AyA has already issued its recommendations for taking over the system and, therefore, an ASADA cannot be established in the area. In all other respects, that section reiterates what was stated previously: the Institute has acted in accordance with the law and issued the corresponding recommendations, and to date there is no response pending from this Office of the Deputy Manager for Community Systems Management. Furthermore, the matter of sealing wells does not fall within the jurisdiction of the Instituto Costarricense de Acueductos y Alcantarillados; therefore, the Dirección de Aguas del Ministerio de Ambiente y Energía need not coordinate with AyA in order to proceed.
LEGAL GROUNDS (…) Here, by contrast, it has been demonstrated that AyA has already issued its recommendations concerning the improvements necessary for it to take over the system, and what remains pending is compliance by those responsible for the urban development (desarrollo urbanístico), Quintas la Ceiba de Tierra Dorada. In this regard, see technical report No. GSP-RPC-2018-00586, entitled “Quintas la Ceiba de Tierra Dorada,” dated 16 de octubre del 2018, submitted by the appellant as evidence No. 16, appearing in images 94 through 96 of the appellant’s filing and evidence contained in the digital case file (expediente digital) of this Constitutional Court; that report concludes: “Conclusions. AyA remains awaiting a determination regarding the matters noted in the foregoing discussion concerning the required information, so that it may be clearly determined whether the Institution can take over the administration of the drinking-water supply system for the Quintas La Ceiba Tierra Dorada project, in accordance with the express wishes of its residents.” (boldface added) Regarding the material impossibility of granting new services.
(…) It is important to note that, given the time elapsed since report No. GSP-RPC-2018-00586, dated 16 de octubre del 2018, was issued, the recommendations made therein must be updated before AyA assesses whether to take over operation of the system supplying the Quintas La Ceiba Tierra Dorada urban development, with the applicants bearing the costs of both the assessments and the necessary improvements. Regarding a legal or material impossibility to provide a service, the Constitutional Chamber has repeatedly held that this does not violate fundamental rights (decisions número 2009-011529 and número 2010-013690) (…) Regarding matters of ordinary legality (asuntos de mera legalidad). We consider that this matter falls within those characterized by the case law of the Constitutional Chamber as “matters of ordinary legality,” because the appellant has repeatedly been informed of the improvements that the system requires before the Institute can directly take over the Quintas La Ceiba Tierra Dorada development, where the appellant resides and owns a parcel.
Furthermore, Mr. [Nombre317 001]’s disagreement concerns the well-sealing procedure, a procedure falling solely and exclusively within the jurisdiction of the Dirección de Aguas del Ministerio de Ambiente y Energía. In this regard, the Constitutional Chamber, in its interpretation, has stated that certain proceedings do not fall within the cognizance of the constitutional jurisdiction (jurisdicción constitucional)2; that is, cases involving matters of ordinary legality rather than constitutionality, which must be heard through the corresponding ordinary proceedings (…) As follows from the Reglamento para la prestación de los servicios de AyA, Acuerdo de Junta Directiva No. 2019-461, published in the Diario Oficial La Gaceta No. 242, Alcance No. 285, dated 19 de diciembre del 2019, service-availability certificates (constancias de disponibilidad de servicios) cannot be issued when there is no technical feasibility (viabilidad técnica), when doing so would impair the quality of the service being provided, or when infrastructure is lacking.
According to report No. GSP-RPC-2018- 00586, dated 14 de junio del 2018 (which must be updated by the interested parties), these conditions must be remedied before interconnection with the systems operated by the Instituto Costarricense de Acueductos y Alcantarillados (…)”.
Justice Araya García drafted the opinion; and,
WHEREAS:
In a written submission filed on 4 de diciembre de 2020, Wendy Simpson Roberts, in her capacity as president of Ganadera La Ceiba S.A., with the powers of an unlimited general agent (apoderado generalísimo sin límite de suma), requested that the company be admitted as an active intervenor (coadyuvante activa) in these proceedings. She asserts that the MINAE action set forth in official letter No. DA-UHTPCOSJ-2123-2020 of 28 de setiembre de 2020 violates the right of access to drinking water of the families residing in the Quintas La Ceiba residential complex. She further states that the decision recorded therein was made without granting a prior hearing. Consequently, she requests that the petition be granted and that the closure order issued through official letter No. DA-UHTPCOSJ-2123-2020 of 28 de setiembre de 2020 by officials of the UH-Tárcoles-Pacífico Central of the MINAE Water Directorate be annulled. She also requests that ICAA be ordered to guarantee the residents a regular supply of drinking water.
In this regard, section 34, paragraph 3°, of the Ley de la Jurisdicción Constitucional provides that anyone possessing a legitimate interest (interés legítimo) in the proceeding may participate as an intervenor, whether on the claimant’s or respondent’s side. Consequently, pursuant to the aforementioned procedural provision and in view of the statements made by the intervenor, the requested intervention is admissible.
The petitioner—in his capacity as President of [...]—states that, through official letter No. DA-UHTPCOSJ-2123-20 of 28 de septiembre de 2020, the MINAE Water Directorate, in clear violation of the right of access to drinking water, ordered the closure of the well supplying the residential project known as Quintas Residenciales La Ceiba after determining that it was operating unlawfully. He alleges that this was ordered without notice to or a prior hearing for the interested parties (more than 100 property-owning families), because the cited document was communicated only to the developer and offending company (Ganadera La Ceiba S.A). He further alleges that ICAA and ARESEP were not consulted beforehand as a means of seeking an alternative solution for the residents. He adds that, despite the requests submitted to them, the ICAA authorities have not provided a solution to the situation faced by the property owners in that residential complex. He likewise maintains that the company that sold the properties, together with the other companies directly involved in supplying and billing for the water, must assume responsibility for resolving the situation under review.
The following facts relevant to deciding this amparo proceeding have been established:
“(…) BACKGROUND. [...], represented by Dr. [Nombre317 001] (…) requests that AyA administer the drinking-water supply for the project known as Quintas La Ceiba Tierra Dorada (…) consisting of agricultural parcels. INTRODUCTION. The aforementioned project was developed more than 20 years ago and currently consists of more than 75 lots, some fronting a public street and the vast majority fronting an agricultural easement (servidumbre agrícola). The water service was administered and supplied by the company that sold the land, Ganadera La Ceiba S.A., through a private supply network, which currently operates subject to certain limitations, particularly legal and billing-related limitations. That company, together with the residents, has agreed to donate the necessary infrastructure to AyA, including land, a well equipped in accordance with the institution’s requirements, and a tank or tanks, so that AyA may assume responsibility for administering the drinking-water supply system.
OBJECTIVE. For AyA to conduct the necessary studies based on the information provided by the residents’ association, as well as on the works carried out by it, in order to determine whether the project’s water-supply system may be transferred so that AyA may assume its administration and, consequently, the supply of drinking water in the area. Discussion: ANALYSIS. To accomplish what has been proposed by the residents’ association, the project must meet the following requirements: 1. Approval (visado) of the subdivision of the registered property (segregación de la finca), in accordance with Article 36 of the Urban Planning Law and Articles 11.2.1 and 50, 51, 52, 53, 54 and 55 of the Reglamento Nacional para el Control del Fraccionamiento y Urbanización, the latter five articles insofar as they concern agricultural parceling (parcelamiento agrícola); as an exception, this requires approval from INVU.
All of the foregoing is required for provision of the service to be legally, environmentally, and technically feasible. 2. The service to be supplied must be adequate in terms of quality, quantity, and continuity; accordingly, the infrastructure must support this, as well as provide reserve capacity for the area’s organic growth. 3. The project’s internal roads must be public streets or agricultural easements; the former must be registered as such within Orotina’s cantonal road network, while the latter must be registered as rights-of-way and aqueduct easements (servidumbres de paso y acueducto) in favor of AyA, permitting free passage along them as well as the installation of infrastructure. 4. The existing distribution network must be evaluated with respect to characteristics such as diameter, material, pipe schedule, installation, and any other factor that must be considered for its possible acceptance or, failing that, to determine whether it must be replaced.
These pipelines must comply with the Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial. 5. As stated in the request, the required infrastructure must be complete, including a fully equipped well with the necessary protection, the protection areas established by the hydrogeological study, a 72-hour pumping test, which must be conducted, and all available information and information yet to be obtained concerning the well. It must also include the disinfection system, pumping mains, storage tank, and distribution network. 6. All infrastructure to be constructed and/or already existing must be approved by AyA in accordance with the established regulations. 7. The nature of the development must be defined; that is, whether it is intended for tourism, residential, agricultural, or another use. 8. Matters concerning the installation of individual metering (micromedición) (water meters) or their supply must be defined by the interested parties.
CONCLUSIONS. AyA awaits the determination of the matters identified in the foregoing discussion concerning the required information, so that it may be clearly established whether the institution can assume administration of the drinking-water supply system for the Quintas la Ceiba Tierra Dorad project, in accordance with the express wishes of its residents (…)” (see evidence).
“(…) For the information of the members of the Board of Directors, I am attaching the report prepared by the Central Pacific region concerning the request by the residents of the Asociación Quintas La Ceiba Tierra Dorada that AyA assume administration of the system. Accordingly, this report should be provided to the residents, and they should be informed that they must coordinate with the Central Pacific region to meet all the requirements set forth in the report so that it will be feasible for AyA to assume administration. They must be informed that engineers German Araya and Leonardo Moya will be responsible for coordinating with them on all matters related to this issue (…)” (see evidence).
“(…) As part of the follow-up to the referenced resolution, attached you will find the report submitted by the Peripheral Systems Management Deputy Division, memorandum SG-GSD-2018-00616, reviewed at ordinary session N° 2019-08 of the Board of Directors, held on 19 de febrero 2019. As indicated by the attached technical study, the requirements established in the technical report must be fulfilled before the aqueduct may be taken over. Any additional information may be coordinated with the Central Pacific Region (…)” (see evidence).
“(…) Conclusions 1- The area contains a residential estate-lot development. 2- The well under expediente 20209PA is undergoing an unnumbered well-amnesty proceeding and does not have an authorized water-use concession (concesión de aprovechamiento de agua). 3- Water from the well is being used unlawfully.4- The well is used for the public supply of water to at least 65 properties, despite having been applied for as a livestock-watering use. 5- There are no concessions registered under Nombre317 of Tyrica S.A. 6- Tyrica S.A. charges the owners of the estate lots for water service. Recommendations: 1- File a criminal complaint with the Prosecutor’s Office for the offense of unlawful appropriation of water (usurpación del agua). 2- Notify ARESE of the unlawful charge for the public service. 3- Issue the well-sealing order because of the inconsistencies in the expediente and irregularities in its use (…)” (see report and evidence).
That almost all the properties on the streets known as Dirección2419, Dirección2417 and el Higuerón have meters, and the private company TYRICA S.A. is responsible for billing for the water service. That it was apparent that the well was being used for a public-supply purpose different from the one requested and that profit was being made from the sale of the service. Consequently, pursuant to Decreto Ejecutivo No. 35884-MINAE (Reglamento de Perforación del Subsuelo para la Explotación y Aprovechamiento de Aguas Subterráneas), the closure and sealing of the well were ordered. In addition, the submission of various documents concerning the well’s closure was requested within thirty days, and it was stated that the well could not be used in any manner without first obtaining the water-use concession (see evidence).
“(…) RECITALS (CONSIDERANDOS) FIRST: That, pursuant to Ley de Aguas No. 276 of 26 de agosto de 1942, the Ministry of Environment, Energy and Telecommunications is responsible for determining and ruling on its ownership, development, use, governance, and oversight. SECOND: That Decreto Ejecutivo 35669-MINAET, published in La Gaceta 3 on 6 de enero de 2010 and amended by decreto 36437-MINAET of 24 de enero del 2011, delegates to the MINAET Water Directorate the authority to admit, process, and decide applications for subsurface drilling for the exploration and extraction of groundwater (aguas subterráneas), and to assign the corresponding well number. THIRD: That Reglamento de Perforación del Subsuelo para la Exploración y Aprovechamiento de Aguas Subterráneas, Decreto Nº 35884-MINAET, governs all matters relating to subsurface drilling for the exploration and extraction of groundwater. FOURTH: That report DA-UHTPCOSJ-2123-2020, dated 28 de septiembre del 2020 and signed by José Ricardo Hidalgo Sánchez and engineer Marilyn Mora Vega, coordinator of the Unidad Hidrológica Tárcoles-Pacífico Central, establishes as proven that the well found on property recorded under real-property folio 377663-000, at Dirección2418, under Nombre317 of GANADERA LA CEIBA S.A., corporate identification number CED5632, was drilled without the corresponding permits from the Ministry of Environment and Energy and is currently being used for human consumption (residential) to supply the Quintas La Ceiba residential project.
Supplying communities is a public-service use and falls within the jurisdiction of the Instituto Costarricense de Acueductos y Alcantarillados or its legally delegated entities; consequently, the cited official communication ordered that the well be sealed (sellado), as established by Decreto Ejecutivo 35884-MINAET. FIFTH: That Article 28, subsection b), of Reglamento de Perforación del Subsuelo para la Exploración y Aprovechamiento de Aguas Subterráneas, Decreto Nº 35884-MINAET, provides as follows: “Article 28.- Criteria for closing wells. The MINAET Water Directorate shall order the closure of a well under the following circumstances: b) When drilling is performed without the required permit.” SIXTH: That Reglamento de Perforación del Subsuelo para la Exploración y Aprovechamiento de Aguas Subterráneas, Decreto Nº 35884-MINAET, likewise addresses the closure of wells and the responsible parties in Article 38, which reads as follows: “Article 38.- Closure of wells.
The MINAET Water Directorate is responsible for issuing instructions regarding the closure and sealing of wells. The costs and expenses of this procedure shall be borne by the owner of the property where the well is located and, secondarily, by the drilling company that performed the drilling and the geologist responsible for it, when their participation in developing the well has been established. The well must be sealed with a metal cover, using waterproof and airtight material to prevent the entry of possible contaminants, and a concrete slab must be poured over the drilling site. A notarial record documenting these measures must be drawn up, all in accordance with the Directorate’s resolution.” (The underlining and highlighting do not appear in the original). SEVENTH: That it is clear that the cited well did not have the corresponding permits and therefore falls within the circumstances contemplated by the cited regulations, pursuant to which the sealing order was issued.
EIGHTH: That on 20 de marzo del 2020, GANADERA LA CEIBA S.A. filed an application to register wells constructed without permits and to authorize a groundwater concession (concesión de aguas subterráneas), pursuant to Decreto Ejecutivo 41851-MP-MINAE-MAG; that proceeding has been stayed because of the CONSTITUTIONAL CHALLENGE (ACCIÓN DE INCONSTITUCIONALIDAD), expediente 19- 017936-0007-CO, and therefore that application cannot be decided until the highest court rules on the matter. NINTH: It is relevant to note that the source corresponding to the well drilled for the extraction and use of groundwater is located on property owned by GANADERA LA CEIBA S. Nombre312. and that this company applied to register the well under the recent amnesty process pursuant to Decreto 41851-MP-MINAE-MAG, but that the merits cannot be considered because of the constitutional challenge cited above. Although this company, as owner of the property, sought legalization of the unnumbered well in expediente 20209-P, the water is used by [...], corporate identification number [Valor CED185].
Likewise, it appears in expediente [Valor 003], as stated in official communications JD-2019- 00063 of 22 de febrero de 2019, for the water-supply system to be assumed through coordination with the Región Pacífico Central de A y A.
THEREFORE (POR TANTO), THE WATER DIRECTOR RULES: THE ORDER TO SEAL THE DRILLED WELL, issued through official communication DA-UHTPCOSJ-2123-2020 of 28 de septiembre del 2020, IS STAYED until the CONSTITUTIONAL CHALLENGE, expediente of the Constitutional Chamber number 19-017936-0007-CO, has been decided. ASOCIACIÓN DE VECINOS QUINTAS LA CEIBA TIERRA DORADA, corporate identification number [Valor CED185], shall enter an appearance. Likewise, it appears in expediente [Valor 003], as stated in official communications JD-2019- 00063 of 22 de febrero de 2019, for the water-supply system to be assumed through coordination with the Región Pacífico Central de A y A. Registration of the well shall be contingent upon a finding, following review of expediente 20209 PA, that the technical and legal requirements established in Decreto 41851-MP-MINAE-MAG have been met; the matter shall be considered once the Constitutional Chamber rules on the constitutional challenge to this decree.
Depending on that outcome, A y A must apply for the corresponding procedure before the Water Directorate. This resolution may be challenged through the ordinary remedies of reconsideration (revocatoria) and appeal (apelación), within the three business days following service of this resolution, pursuant to Articles 343,346 and 347 of Ley General de la Administración Pública, both before this Office. Notice shall be served on AYA; Ms. Yamileth Astorga Espeleta, Executive President; Licda. Cecilia Martínez, Deputy Manager for Community Systems Management; and the Unidad Hidrológica Tárcoles - Pacífico Central (…)” (see evidence).
IV.REGARDING the constitutional challenge processed under expediente No. 19-017936-0007-CO. With respect to this proceeding—by virtue of which processing of the application filed in marzo de 2020 to register the well under review was stayed—the following has been established:
“(…) The challenge concerning the alleged express authorization not to appear before SETENA for the assessment of irregular wells, the alleged risk of salinization or contamination through saline intrusion, and the claimed rampant ineffectiveness of environmental law is unanimously dismissed. By majority vote, the constitutional challenge concerning Articles 1, 2 and 3 of decreto ejecutivo 41851-MP-MINAE-MAG, Reglamento de registro de pozos sin número y habilitación del trámite de concesión de aguas subterráneas, is dismissed, provided those provisions are construed as not modifying the criminal offenses established in Articles 226 and 227 of the Criminal Code; accordingly, determining criminal liability shall fall to the competent criminal judge. Justice Rueda Leal states different grounds regarding the aforementioned claim. By majority vote, the challenge concerning the alleged absence of a comprehensive water balance (balance hídrico integral), the authorization to alter biodiversity’s life cycles without studies, the lack of measures to protect against, mitigate, or prevent harm, and the right to citizen participation is dismissed.
Justices Cruz Castro and Rueda Leal partially dissent and would grant the challenge based on violation of the right to citizen participation. Justice Cruz Castro and Justice Picado Brenes partially dissent and would grant the challenge based on violation of the principle of statutory reservation (principio de reserva de ley) and the lack of measures to protect against, mitigate, or prevent harm. Justice Cruz Castro partially dissents and would grant the challenge based on the alleged absence of a comprehensive water balance and the authorization to alter biodiversity’s life cycles without studies. Justice Cruz Castro and Justice Garro Vargas submit separate opinions. Justices Castillo Víquez and Rueda Leal submit a joint opinion. The motions to intervene in support (coadyuvancias) are unanimously rejected. Notice shall be served (…)” (see expediente No. 19-017936-0007-CO, reviewed ad effectum videndi).
The petitioner (recurrente) appears before this Constitutional Chamber and states that he serves as President of [...]. He explains that the project known as Quintas Residenciales La Ceiba was developed 23 years ago, that it consists of country estates (quintas) of approximately 7.000 square meters each, and that it comprises a total of 100 properties registered as agricultural parcels (predios agrícolas).
It states that the developer of that project was Ganadera La Ceiba S.A., which provided the buyers with registered survey plats (planos catastrados) that complied with the specifications for agricultural parcels and with the potable water service. It explains that, at the time the properties were sold, the developer guaranteed the provision of potable water service through an aqueduct operated by the same company, for which each parcel had its respective meter. It notes that the service was initially provided privately by the seller itself (Ganadera La Ceiba S.A.), through a related company called SERINCON S.A., which was responsible for billing for the service. It states that SERICON S.A. has supplied potable water service since 1997. Beginning in 2017, payments for the water supply have been deposited with another company called TYRICA S.A., which is also related to Ganadera La Ceiba S.A..
It explains that, at the time, they assumed that everything was in order and that the service was being provided legally. However, the petitioner states that at one point there was an excessive increase in the charge for potable water service, so they made inquiries with ICAA and ARESEP, as a result of which they learned that the water supply was not legally compliant because the well supplying that water was not registered with MINAE. It recounts that, in response to that situation, they contacted ICAA so that it would take over the aqueduct, and despite efforts undertaken with that institution since 2016, no concrete solution to the problem has been achieved. It asserts that the greatest difficulty concerns the extent of the works and conditions imposed by ICAA for accepting the well and the service infrastructure, the cost of which must be borne by the residents.
It adds that a resident filed a complaint with MINAE concerning the high cost of potable water service, which resulted in the issuance of official letter No. DA-UHTPCOSJ-2123-20 of 28 de septiembre de 2020, which referred to the illegality of the aforementioned well and ordered its closure within one month.
It alleges that MINAE abruptly ordered the closure of that well without granting all residents of the residential development a prior hearing (because only the offending company was notified) and without conducting due proceedings (debido procedimiento), thereby leaving all of them defenseless. It maintains that the aforementioned residents learned what had occurred through third parties.
It alleges that neither were they granted a prior hearing, nor were the authorities of ICAA and ARESEP consulted as a means of seeking a solution to the situation. All this occurred even though, at the time of the closure, the national emergency due to COVID-19 remained fully in effect, and therefore, in its view, access to potable water service was essential.
It adds that although the Instituto Costarricense de Acueductos y Alcantarillados is the body responsible for undertaking and promoting planning, financing, and development, as well as resolving all matters related to the supply of potable water in the country, the appropriate actions have not been taken to provide a solution for the 100 families affected by the closure of the well and the suspension of water service to their homes. It asserts that ICAA cannot remain uninvolved in the necessary measures to provide the community with potable water and that its participation is therefore necessary to achieve this solution; participation that MINAE itself should have sought before ordering the closure of the well.
Furthermore, it reiterates that when the developer offered the properties for sale, it also offered to provide potable water service, a factor that influenced the purchasers’ decision to acquire the properties. It states that the three aforementioned companies have control and management of that well and are also responsible for reading the water meters (hidrómetros), issuing bills, and collecting payment for water service; it therefore considers it necessary for them to participate in the procedure for transferring the aqueduct to ICAA. Likewise, it considers that they must coordinate with MINAE and ICAA as necessary to satisfy the requirements for that institute to assume management of the community aqueduct.
It therefore maintains that, in this case, the right of access to potable water was violated, as were its rights to a defense and to due process (debido proceso). Consequently, it requests that this amparo proceeding (amparo) be granted and, among other things, that the well-closure order set forth in official letter No. DA-UHTPCOSJ-2123-20 of 28 de septiembre de 2020, issued by the UH-Tárcoles-Pacífico Central of the Dirección de Agua del MINAE, be annulled. It further requests that ICAA be ordered to intervene immediately to guarantee the residents a regular supply of potable water by undertaking such measures and works as may be necessary.
In view of the foregoing, this Chamber observes that the petitioner directs this amparo proceeding toward the following matters: a) that official letter No. DA-UHTPCOSJ-2123-20 of 28 de septiembre de 2020, issued by the Dirección de Agua del MINAE, ordered the closure of the well that supplies the residential complex where 100 families reside, in clear violation of the right of access to potable water and despite the ongoing COVID-19 pandemic; b) that this decision was made without notifying or granting a prior hearing to the 100 families who own the aforementioned country estates (quintas) and, consequently, without respecting due process; c) that, before the aforementioned order was issued, neither ICAA nor ARESEP was consulted for the purpose of finding a solution to the aforementioned problem; d) that the ICAA authorities, despite the requests submitted to them, have not provided a solution to the situation; and e) that the private entities involved in this matter must accept responsibility and remedy the problem described.
That said, after analyzing the grievances presented by the appellant, the reports submitted under oath by the respondent authorities, and all evidence entered into the record, this Constitutional Court finds no grounds whatsoever for granting this amparo proceeding or, concomitantly, the claims advanced by the protected party. This conclusion is based on the reasons set forth below.
A. Regarding the provisions of official letter No. DA-UHTPCOSJ-2123-20 and the need to obtain potable water during the COVID-19 pandemic. First, it must be noted that, in this case, this Chamber does not find in any respect that the action challenged by the petitioner—namely, the closure and sealing of the well located on property No. 377663-000 (owned by Ganadera La Ceiba S.A.), which has supplied the development known as Quintas Residenciales La Ceiba for several years—may be deemed arbitrary or unfounded. In this matter, it has been demonstrated with sufficient clarity that the owners of the properties located in the aforementioned residential complex have been provided water service—apparently, as allegedly arranged by the aforementioned development company, Ganadera La Ceiba S.A.—through an illegally constructed well, that is, a well for which the corresponding permits were neither processed nor timely requested and which, consequently, is not duly registered with the Dirección de Agua del MINAE, as required by law (Decreto Ejecutivo No. 35884-MINAE Reglamento de Perforación del Subsuelo para la Explotación y Aprovechamiento de Aguas Subterráneas); hence, its closure was sought. It should be noted that Article 28 of the latter regulation provides as follows:
“Criteria for the closure of wells. The Dirección de Agua del MINAET shall order the closure of a well under the following circumstances:
The foregoing therefore clearly supports the action of the Dirección de Agua del MINAE, specifically the provisions of official letter No. DA-UHTPCOSJ-2123-20 of 28 de septiembre de 2020, challenged by the petitioner in his capacity as President of [...]. It should also be emphasized that this official letter specifically states all the legal and factual grounds supporting the closure at issue, principally including, as stated above, the illegal operation of the well and its use for human consumption rather than as a watering place for 20 head of cattle, as was stated and requested years later—specifically in marzo de 2020—when the aforementioned company submitted an application to legalize the well pursuant to Decreto Ejecutivo No. 41851-MP-MINAE-MAG of 18 de julio de 2019, entitled Reglamento de registro de pozos sin número y habilitación del trámite de concesión de aguas subterráneas (the latter proceeding having been processed under expediente No. [Valor 003]).
Accordingly, it is evident that the owners of the properties located in the aforementioned residential complex have obtained water irregularly for several years and that the authorities of the Dirección de Agua del MINAE have merely undertaken to regularize and bring that situation into legal compliance, as the legal system itself establishes and requires; hence, from that perspective, it cannot be asserted that the closure and sealing of the well at issue violates the fundamental right of access to potable water. On the contrary, pursuant to the provisions of that legal framework, such action seeks to protect water resources (recurso hídrico).
On the other hand, it must be taken into account that, although the challenged official letter No. DA-UHTPCOSJ-2123-20 ordered the closure and sealing of the well, the fact remains—as was also established—that this order was not enforced at that time (that is, in 2020) or subsequently by the authorities of the MINAE Water Directorate. It should be noted that, initially, the Director of Water of MINAE, through resolution No. DA-1769-2020 at 08:17 hrs. on 3 de diciembre de 2020 (issued within the aforementioned proceeding No. [Valor 003]), ordered the suspension of that order until the constitutional challenge (acción de inconstitucionalidad) filed against the provisions of the aforementioned Decreto Ejecutivo No. 41851-MP-MINAE-MAG (which permitted the legalization of irregularly drilled wells) was decided. Additionally, on that occasion, it was clarified that the requested well registration was subject to compliance with the provisions of that body of law (Decreto Ejecutivo No. 41851-MP-MINAE-MAG) and that this application itself would be decided once the Sala Constitucional ruled on that constitutional proceeding.
As established, the latter action was decided and dismissed by this constitutional jurisdiction through Judgment (Sentencia) No. 2021-25386 at 13:10 hrs. on 10 de noviembre de 2021, which, moreover, was served on all parties in marzo de 2022. Subsequently, the authorities of the MINAE Water Directorate, specifically in julio de 2022, informed this Chamber that, at that time, the application to legalize the well in question was still pending and would not be decided until the present amparo proceeding (proceso de amparo) had been resolved. As recently confirmed (that is, on 29 de septiembre de 2023), this situation continues to prevail as of this date. It was also clarified that the well located in the aforementioned project known as Quintas Residenciales La Ceiba had not been sealed and that, accordingly, the residents of that location continue to use it as their water supply. Consequently, based on the foregoing, it cannot be maintained that the petitioner (recurrente) and the other owners of the aforementioned country estates were left without potable-water service, at least during the years when the COVID-19 pandemic was most prevalent and, consequently, when the supply of this resource was most necessary to safeguard the fundamental right to health.
B. Regarding the alleged violation of the right to a defense and due process. In this matter, it has been established and verified that the well in question is located on property owned by the company Ganadera La Ceiba S.A., as confirmed during an inspection conducted by the authorities of the MINAE Water Directorate in septiembre del año 2020, and not on property registered under Nombre317 of the protected Asociación de Vecinos Quintas La Ceiba Tierra Dorada itself or under Nombre317 of any other individual resident. It was therefore fully justified for the authorities of the Water Directorate, on 4 de noviembre de 2020, to serve the aforementioned official letter No. DA-UHTPCOSJ-2123-20 specifically on the owner or representative of the property where the well was constructed and is operated, since that person—pursuant to the provisions of the aforementioned Decreto Ejecutivo 35884-MINAE Reglamento de Perforación del Subsuelo para la Explotación y Aprovechamiento de Aguas Subterráneas—was required to carry out the corresponding closure and sealing. It should be noted that, in this regard, Article 38 of the latter decree provides as follows:
“Closure of wells. The MINAET Water Directorate shall issue instructions concerning the closure and sealing of wells. The costs and expenses of this procedure shall be borne by the owner of the property on which the well is located; and, subsidiarily, by the drilling company that performed the drilling and the geologist responsible for it, when their involvement in the development of the well is established. The sealing must be performed using a metal cover and waterproof, airtight material to prevent the entry of potential contaminants, and a concrete slab must be poured over the drilling site. A notarial record (acta notarial) documenting these measures must be executed, all in accordance with the provisions of the Directorate’s resolution.” (Underlining does not appear in the original).
In parallel with the foregoing, it must be clear in this matter that the MINAE Water Directorate is not, and does not act as, the provider of potable-water service in the residential complex under review. At no time has it entered into any type of relationship on that basis with any of the owners of the 100 properties referenced by the protected party; indeed, our legal system grants it no authority whatsoever in that regard. Consequently, that Directorate cannot be charged with an obligation to notify each of those owners (in their alleged capacity as beneficiaries of the water-supply service) of the provisions of the aforementioned official letter No. DA-UHTPCOSJ-2123-20. It is evident that the Water Directorate merely brought the use of the well into compliance with the law and, from that perspective, its role was limited to notifying the owner of the property on which the well was located of the closure and sealing order in question, as it in fact did. Accordingly, it cannot be asserted in this case that the rights to a defense and due process of the owners of the aforementioned properties comprising the residential development were violated.
In any event, it is important to emphasize that the petitioner himself stated in the petition initiating this amparo proceeding that the owners of the properties located in the aforementioned residential complex learned of the closure order in question through other means. Indeed, the body of evidence submitted by the petitioner includes several official letters dated 17 de noviembre de 2020 establishing that a representative of Ganadera La Ceiba S.A. notified certain owners of the country estates of the sealing order set forth in the aforementioned official letter No. DA-UHTPCOSJ-2123-20 of 28 de septiembre de 2020. This being so, it is clear that, before this amparo proceeding was filed, the owners of the aforementioned properties were aware of the order to close the well that supplied them with water, which consequently allowed them, at that time, to pursue any actions they deemed appropriate to regularize the situation under review.
Indeed, it is important to note that it has been fully established in this matter—as the petitioner himself related in the petition initiating this proceeding—that the residents of the aforementioned residential development had known for many years (at least since 2013) of the irregular situation affecting the provision of their water service (because the well was operating illegally), to the extent that, in 2016 and 2018, they sought assistance from the ICAA authorities so that the institution would take over the aqueduct operating at the location. Consequently, it is clear that the closure order issued by the Water Directorate in septiembre de 2020 cannot be considered sudden and arbitrary under the terms presented and alleged before this Court, since it was to be expected that the MINAE authorities would, sooner or later, act in that manner, following, as repeatedly stated, the provisions of our legal system (Decreto Ejecutivo No. 35884-MINAE).
C. Regarding the alleged obligation to coordinate in advance with ARESEP and ICAA. Consistent with the preceding section, this Chamber considers that the MINAE Water Directorate, pursuant in turn to the provisions of the aforementioned Decreto Ejecutivo No. 35884-MINAE, fulfilled its specific obligation to notify the owner of the property on which the well is located of its closure. That same body of law neither indicates nor imposes an obligation to undertake the action sought by the claimant, namely, to coordinate with other institutions (in this case, ARESEP and ICAA) before closing the well in order to find a solution to the water-supply problem in the residential complex. Through this allegation, the petitioner is essentially suggesting that MINAE should have indefinitely suspended enforcement of the aforementioned regulations (and perpetuated the use and operation of an illegally constructed well) until one of those two institutions, primarily ICAA, fully resolved the situation in which the residents of the aforementioned residential development found themselves and currently remain, for reasons apparently unrelated to the public administration.
In the opinion of this constitutional body, however, that proposition is not plausible, since the Ministry’s duty was to ensure the closure of the well and nothing more. This is because, as stated, the MINAE Water Directorate has never acted as the potable-water service provider for the properties under review.
In any event, as also stated above, the record in this matter shows that since at least 2016—that is, four years before the official letter in question, No. DA-UHTPCOSJ-2123-20, was issued—ICAA was aware of the matter under review, as members of [...] had brought it to its attention, although no solution was reached at that time. It was also established that two years later, that is, in septiembre de 2018, the petitioner submitted a formal request to the ICAA Board of Directors for that institution to administer the potable-water supply in the aforementioned housing development. This could not be done, however, because the interested parties had not met the requirements established for that purpose. Therefore, it has been conclusively verified in this matter that, although MINAE did not engage in the prior coordination sought by the claimant when it issued the administrative act (acto administrativo) under review—which, as stated, was not in any event required by the legal system—the fact remains that ICAA was already aware of the problem under review at that time and had already expressed its position regarding how the situation could be resolved (the latter issue will be addressed in detail in the following section).
D. Regarding the alleged failure of ICAA to resolve the situation concerning the potable-water supply in the residential complex. Contrary to the petitioner’s allegation, this Constitutional Court does not consider that the ICAA authorities can be charged with or attributed any arbitrary act or omission in this matter that infringed the fundamental rights of the residents of Quintas Residenciales La Ceiba. It should be observed that, in this matter, as noted above, the record shows that the interested parties (residents of that residential development) approached this institution on two occasions and that, although the institution has not taken over the aqueduct and, consequently, the potable-water supply in that residential complex, this is due to an important reason: the interested parties have not complied with a series of requirements and technical specifications that were communicated and brought to their attention several years ago.
Specifically, it was determined that, in 2016, some members of [...] met with two ICAA engineers to propose that the latter take over the residential complex’s aqueduct. On that occasion, as was also established, those officials requested compliance with several requirements for that purpose (e.g., detailed information on the pumping test, the amount of water yielded by the well, water-quality analyses, the survey plan of the property where the well is located and a possible easement (servidumbre), etc.). It was also verified that, some time later, in September 2018, the appellant submitted a formal request to the ICAA Board of Directors for that institution to manage the drinking-water supply in the aforementioned housing development. The ICAA Board of Directors referred that request to the ICAA Submanagement Office for Delegated Systems Management, as a result of which Report No. GSP-RPC-2018-00586 dated 16 de octubre de 2018, entitled Informe técnico Quintas La Ceiba Tierra Dorada, was issued and signed by an official from the ICAA’s Región Pacífico Central. The report stated that, for the applicant’s request to be granted, a series of requirements had to be met, including the following:
“(…) 1. Approval (visado) of the segregation (segregación) of the property, in accordance with Article 36 of the Ley de Planificación Urbana and Articles 11.2.1 and 50, 51, 52, 53, 54 and 55 of the Reglamento Nacional para el Control del Fraccionamiento y Urbanización, the latter five articles insofar as they concern agricultural parceling (parcelamiento agrícola); as an exception, requiring INVU approval for that purpose. All of the foregoing is required so that provision of the service is legally, environmentally, and technically feasible.
2. The service to be supplied must be adequate in terms of quality, quantity, and continuity; accordingly, the infrastructure must be capable of providing it, as well as maintaining a reserve for the area’s organic growth.
3. The project’s internal roads must be public roads or agricultural easements (servidumbres agrícolas); the former must be registered as such within Orotina’s cantonal road network, while the latter must be registered as rights-of-way and aqueduct easements in favor of AyA, allowing free passage over them as well as the installation of infrastructure.
4. The existing distribution network must be evaluated with respect to characteristics such as diameter, material, pipe schedule, installation, and any other factor that must be considered for its possible acceptance or, failing that, to determine whether it must be replaced. These pipelines must comply with the Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial.
5. As stated in the request, the required infrastructure must be complete, including the fully equipped well with the necessary protection, the protection areas established by the hydrogeological study, a 72-hour pumping test, which must be conducted, and all available information and information yet to be obtained from it. It must also include the disinfection system, pumping mains, storage tank, and distribution network.
6. All infrastructure to be built and/or already existing must be approved by AyA in accordance with the applicable regulations.
7. The nature of the development must be defined—that is, whether it is for tourism, residential, agricultural, or another type of use.
8. Matters concerning the installation of individual metering (micromedición) equipment (water meters) or its supply must be defined by the interested parties (…)”.
According to the information provided by the ICAA authorities—and as the claimant himself even acknowledged in the filing instituting these amparo proceedings—none of these requirements had been met. Consequently, the Institute had been unable to take over the aqueduct and provide drinking-water service as requested.
It may therefore readily be concluded that the ICAA authorities have at no time refused, without justification or arbitrarily, to provide the service under consideration, contrary to how the protected party portrays or presents the matter before this constitutional jurisdiction. What is occurring in this case is that, before taking the requested action, the ICAA requires compliance with a series of requirements in accordance with the legal system; it is not possible in this particular case to make an unlawful exception and provide service to the project known as Quintas Residenciales La Ceiba, as the appellant would appear to want. It should be noted that this Chamber has repeatedly held that drinking-water service may validly be denied when the requirements established for that purpose have not been met. Thus, Voto No. 2009-9936 of 14:08 hrs. on 19 de junio de 2009 stated as follows:
“(…) Accordingly, its status as a fundamental right does not entail unrestricted access to water services, since the government may validly establish general requirements that each applicant must meet so that the applicant’s particular request may be assessed. The possibility is therefore recognized of limiting the granting of new water connections (pajas de agua) for the purpose of ensuring the continued provision of the public drinking-water supply service to current users and households receiving that service—see Judgments Nos. 2007-17475, at eleven hours and five minutes on treinta de noviembre de dos mil siete, and 2008-11390, at eleven hours and twenty-nine minutes on veintidós de julio de dos mil ocho. In this regard, in Judgment No. 2006-1898, at nine hours and fifty-three minutes on diecisiete de febrero de dos mil seis—reiterated, among others, in Judgment No. 2007-13310, at ten hours and fifty-seven minutes on catorce de setiembre de dos mil siete—the Chamber held:
‘The appellant alleges (…) that, despite the requests and efforts made, the respondent Institute has refused to provide them with drinking-water service, asserting that it is an informal settlement and that its residents do not have a segregation plan establishing that they own the properties. In this regard, the record establishes, based on the respondent authority’s sworn report, that it is impossible to install residential drinking-water services in the community where the appellant lives for two specific reasons: the lack of adequate infrastructure and the interested parties’ failure to submit applications meeting the legal requirements (...). In Judgment No. 2004-12185 at 13:31 hours on 29 de octubre del 2004, in a case similar to this one, this Chamber held that the Instituto Costarricense de Acueductos y Alcantarillados could not be compelled to disregard the provisions of its Reglamento de Prestación de Servicios a los Clientes or the Ley General de Agua Potable.
Therefore, unless the protected party satisfies the conditions and requirements established therein, drinking-water service cannot be provided to him on a regular basis, even though it must be accessible to everyone because it is an essential service. Given the existence of these two objective reasons why regular drinking-water service cannot be supplied to the claimant—his failure to meet the requirements for connecting a new service, beginning with submission of the application, and the lack of adequate infrastructure in the area—there is no reason to conclude that the respondent Institute’s denial of regular service is due to the fact that the protected party and his neighbors do not hold title to the properties they possess. It should be added that, pursuant to Article 33 of the aforementioned Reglamento, the lack of title does not appear to preclude applying for a new drinking-water connection, provided that the requirements set forth in that provision are met.
In any event, it has also been established that, although regular drinking-water service has not been supplied, the appellant and the other residents have access to a public standpipe installed by the Institute so that they may obtain water for their basic needs. Accordingly, this Court finds that it is the appellant’s and the local residents’ own omission, as they have not shown that they submitted applications for the installation of a new drinking-water service in the community where they live, that has prevented their situation from being assessed to determine whether—particularly if they comply with the requirements of Article 33 of the Reglamento de Prestación de Servicios a los Clientes—the infrastructure limitations can be overcome in their case and they can be provided with regular drinking-water service.’ It is therefore understood that, although there is a fundamental right to water that may be asserted against the relevant government authority, provision of the service may properly be made subject to compliance with the requirements established for granting it and to the material possibility of supplying it; that is, there must be no technical circumstances that prevent or counsel against the government authority’s provision of drinking-water service.
Thus, the government authority has no obligation to provide drinking-water service when technical reasons counsel against or prevent doing so, and it must adequately inform the applicant of the reasons why the request cannot be granted (…)”.
For its part, in Judgment No. 2018-7781 at 09:15 hrs. on 18 de mayo de 2018, this Chamber stated:
“(…) III.- REGARDING THE DENIAL OF DRINKING-WATER SERVICE. This Chamber has found that, although there is a fundamental right to drinking water, its exercise is not indiscriminate such that entities providing that service are obligated to provide it under any conditions and at any time. Specifically, this Chamber has recognized that the Instituto Costarricense de Acueductos y Alcantarillados, municipalities, or aqueduct and sewer system administrative associations may deny the availability of drinking water when justified by technical reasons. In Judgment No. 2009-003825 at 16:49 hours on 10 de marzo de 2009, reiterated in Judgment No. 2016-005382 at 9:05 hours on 22 de abril de 2016, this Chamber ruled as follows:
‘(...) It is therefore understood that, although there is a fundamental right to water that may be asserted against the relevant government authority, provision of the service may properly be made subject to compliance with the requirements established for granting it and to the material possibility of supplying it; that is, there must be no technical circumstances that prevent or counsel against the government authority’s provision of drinking-water service. Thus, the government authority has no obligation to provide drinking-water service when technical reasons counsel against or prevent doing so, and it must adequately inform the applicant of the reasons why the request cannot be granted (…)’”.
Concurrently, it is necessary to cite what the ICAA Submanager of Peripheral Systems reported regarding this matter under oath, namely, the following:
“(…) all the information required by AyA, as set forth in the technical report, constitutes essential requirements for AyA to assume administration of the aqueduct; therefore, the Institution has expressed its willingness to meet the community’s water-supply needs, provided that the requested information is submitted, the improvements determined by the Institution’s technical personnel are carried out, and the conditions for access to the properties and their respective registrations are defined. All of the foregoing must comply with the body of regulations governing the conditions binding the Institute in relation to users and the requirements necessary for the provision of the service, which are contained in the Reglamento para la Prestación del Servicio de AyA, in Article 7 (…)” (Underlining does not appear in the original).
Furthermore, this authority held that:
“(…) if the appellant submits the information requested in the report prepared by the Dirección de Operación y Mantenimiento in October 2018, so that the current conditions of the system and access thereto may be determined and the improvements subsequently identified by the Institution’s technical personnel may be carried out, the aqueduct can be taken over and the current water-resource conditions affecting the residents of Quinta La Ceiba can be remedied (…)”. (Underlining does not appear in the original).
Accordingly, it has been established in this matter that the ICAA authorities have not left the residents of the aforementioned residential development without assistance, given that for several years they have proposed a project to take over the aqueduct and provide them with potable-water service. If this has not materialized, it is because the residents have not complied with the requirements imposed upon and communicated to them.
E. Regarding the appellant’s request that the companies associated with the residential complex assume responsibility in this case. Finally, the appellant must be advised that the request seeking to have the companies involved in this matter—primarily the developer Ganadera La Ceiba S.A.—take responsibility for the situation under review and provide a solution concerning the provision of potable-water service in the aforementioned residential development must, should he deem it appropriate, be brought through the ordinary legal proceedings specifically established for that purpose. It should be noted that a substantive analysis of the case under review falls outside the jurisdiction of this Constitutional Court because it concerns a matter of ordinary legality—specifically, the agreements reached, when the country properties were purchased, between the owners of the properties comprising the aforementioned residential development and the developer Ganadera La Ceiba S.A. (or any other private-law party), as well as all specific matters directly related to the provision of water service at the site—and, consequently, determining whether that company or another party must assume any form of responsibility for the situation and case described herein.
It is neither materially nor reasonably possible to undertake a complex and protracted evidentiary process to clarify the aforementioned matters raised by the protected party. Therefore, as already stated, this particular grievance must be brought through the corresponding ordinary legal proceedings, since it clearly exceeds the summary nature of the application for constitutional relief (recurso de amparo), as well as the jurisdiction conferred upon this Court by the Ley de la Jurisdicción Constitucional and the Constitución Política itself.
* In view of the foregoing, because it has not been shown in this case that the respondent authorities committed any violation of the fundamental rights of the appellant or of the other property owners in the Quintas Residenciales La Ceiba project, this constitutional protection proceeding (proceso de amparo) must be dismissed.
VI.Nevertheless, notwithstanding the foregoing, the authorities of the Instituto Costarricense de Acueductos y Alcantarillados must be advised that, once the owners of the properties comprising the Quintas Residenciales La Ceiba project have fulfilled all the technical and legal requirements imposed upon them, the appropriate determination under the law must be made, provided that no cause unrelated to the one examined in the matter before the Court (sub lite) prevents it.
VII.Documentation submitted to the case file. The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, these must be collected from the Court within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, approved by the Corte Plena at session number 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session number 43-12 held on May 3, 2012, Article LXXXI.
POR TANTO:
The application is denied. The authorities of the Instituto Costarricense de Acueductos y Alcantarillados shall take note of the provisions set forth in whereas clause (considerando) VI of this judgment.

Revisión del Documento Res. Nº PHO7951 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veintisiete minutos del seis de octubre de dos mil veintitres .
Recurso de amparo interpuesto por [Nombre317 001], cédula de identidad [CED168 ], a favor de [...], cédula jurídica [Valor CED185], contra EL MINISTERIO DEL AMBIENTE Y ENERGÍA (MINAE) y EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADO (ICAA).
RESULTANDO:
Redacta el Magistrado Araya García; y,
CONSIDERANDO:
Por escrito aportado el 4 de diciembre de 2020, Wendy Simpson Roberts, en su condición de presidenta con facultades de apoderado generalísimo sin límite de suma de Ganadera La Ceiba S.A., solicitó se tuviera a dicha sociedad como coadyuvante activa del presente proceso. Afirma que la actuación del MINAE consignada en el oficio No. DA-UHTPCOSJ-2123-2020 de 28 de setiembre de 2020 violenta el derecho de acceso al agua potable de las familias que habitan en el complejo residencial Quintas La Ceiba. Asimismo, expone que la decisión ahí consignada se tomó sin otorgarse audiencia previa. En consecuencia, solicita que se declare con lugar el recurso y se anule la orden de cierre dispuesta mediante el oficio No. DA-UHTPCOSJ-2123-2020 de 28 de setiembre de 2020, emitido por los funcionarios de la UH-Tárcoles-Pacífico Central de la Dirección de Agua del MINAE. Además, que se le ordene al ICAA garantizar a los vecinos el abastecimiento regular de agua potable.
Sobre este particular, el numeral 34, párrafo 3°, de la Ley de la Jurisdicción Constitucional, estipula que quien posea un interés legítimo en el proceso puede intervenir, sea en su perfil activo o pasivo, como coadyuvante. En consecuencia, en virtud de lo dispuesto en la norma de rito supra señalada y lo expuesto por la mencionada interviniente, resulta admisible la referida coadyuvancia.
El recurrente –en su condición de Presidente de [...]–, señala que mediante el oficio No. DA-UHTPCOSJ-2123-20 de 28 de septiembre de 2020, la Dirección de Agua del MINAE, en claro quebranto al derecho de acceso al agua potable, dispuso el cierre del pozo que abastece el proyecto residencial llamado Quintas Residenciales La Ceiba, al haberse verificado que este operaba al margen de la ley. Acusa que lo anterior se ordenó sin notificarse u otorgarse audiencia previa a los interesados (más de 100 familias propietarias), pues el citado documento solamente se le comunicó a la empresa desarrollada e infractora (Ganadera La Ceiba S.A). Además, alega que no se le consultó previamente al ICAA o a la ARESEP, como medio para buscar una solución alternativa a los vecinos. Agrega que, por su parte, las autoridades del ICAA, pese a las gestiones que le han sido formuladas, no han brindado una solución a la situación que afrontan los propietarios de los inmuebles de dicho complejo residencial. Igualmente, sostiene que la empresa que vendió las fincas (y las otras relacionadas con el suministro y cobro propiamente del agua), deben hacerse responsables de solventar la situación bajo estudio.
De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:
“(…) ANTECEDENTES. [...], representados por el Dr. [Nombre317 001] (…) solicita al AyA la administración del suministro de agua potable de dicho proyecto denominado Quintas La Ceiba Tierra Dorada (…) consistente en parcelas agrícolas. INTRODUCCIÓN. El Proyecto mencionado se desarrolló hace más de 20 años, constando actualmente de más de 75 lotes, algunos con frente a calle pública y la gran mayoría con frente a servidumbre agrícola. El servicio de agua era administrado y suministrado por la sociedad que vendió los terrenos, Ganadera La Ceiba S.A. mediante una red de abastecimiento privada, misma que hoy funciona con algunos limitantes, especialmente legales y de cobro. Dicha sociedad ha acordado en conjunto con los vecinos el donar la infraestructura necesaria al AyA, Incluyendo terrenos, pozo equipado de acuerdo a lo que establezca la institución, tanque o tanques, para que esta se encargue de la administración del sistema de abastecimiento de agua potable.
OBJETIVO. Realizar los estudios necesarios por parte del AyA, a partir de la información que suministre la asociación de vecinos, así como las obras que realice, para determinar la posibilidad de lograr el traspaso del sistema de abastecimiento de agua del proyecto, de modo se asuma su administración y por lo tanto, el suministro de agua potable en la zona. Desarrollo del tema: ANÁLISIS. Para el logro de lo planteado por la asociación de vecinos, el proyecto debe cumplir con los siguientes aspectos: 1. Visado de la segregación de la finca, conforme a lo dispuesto en el artículo 36 de la Ley de Planificación Urbana y en los artículos 11.2.1 y 50, 51, 52, 53, 54 y 55 del Reglamento Nacional para el Control del Fraccionamiento y Urbanización, estos últimos cinco artículos en lo correspondiente a parcelamiento agrícola; como excepcionalidad, requiriendo para ello el visado del INVU. Todo lo anterior para que la prestación del servicio sea legal, ambiental y técnicamente factible. 2.
El servicio a suministrar debe ser adecuado en cuanto a calidad, cantidad y continuidad, por lo que la infraestructura lo debe permitir, así como un remanente para crecimiento vegetativo de la zona. 3. Las calles internas del proyecto deben ser calles públicas o servidumbres agrícolas, debiendo estar inscritas las primeras como tales dentro de la red vial cantonal de Orotina, mientras las segundas como servidumbres de paso y acueducto a favor del AyA, que permitan la libre circulación por ellas, así como la posibilidad de instalación de infraestructura. 4. La red de distribución existente debe ser evaluada en cuanto a sus características como diámetro, material, cédula, instalación y cualquier otro elemento que debe ser considerado para su posible aceptación, o en su defecto, que deba ser sustituido. Estas tuberías deben cumplir con la Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial. 5.
Tal y como lo establece la solicitud, la infraestructura requerida debe ser completa, incluyendo el pozo totalmente equipado y con la protección necesaria, las áreas de protección que establezca el estudio hidrogeológico, prueba de bombeo de 72 horas, lo cual es necesario realizar, y toda la información disponible y por obtener de él. Así mismo debe incluir el sistema de desinfección, tuberías de impulsión, tanque de almacenamiento y red de distribución. 6. Toda la infraestructura a construir y/o existente debe ser aprobada por el AyA, de acuerdo a la normativa establecida. 7. Definir las características del desarrollo, esto es, si es de tipo turístico, habitacional, agrícola u otro. 8. Los aspectos de la instalación de la micromedición (hidrómetros) o su suministro deberá ser definido por los interesados. CONCLUSIONES. El AyA queda a la expectativa y espera de la definición de lo señalado en el desarrollo anterior en cuanto a la información requerida, de modo se pueda definir con claridad la posibilidad de que la institución pueda asumir la administración del sistema de abastecimiento de agua potable del proyecto Quintas la Ceiba Tierra Dorad, según voluntad expresa de sus vecinos (…)” (ver prueba).
“(…) A efecto que se de a conocer a los señores (as) miembros de la Junta Directiva, le adjunto el informe que preparó la región Pacífico Central relacionado con la solicitud de los vecinos de la Asociación Quintas La Ceiba Tierra Dorada, en el sentido de que AyA asuma la administración del sistema. Por lo tanto, lo que corresponde es que se les dé a conocer este informe a los vecinos y se les indiqué (sic) que deben coordinar con la región Pacífico Central a fin de que cumplan con todos los requisitos anotados en el informe para que sea factible que AyA asuma la administración. Se les debe indicar que los ingenieros, German Araya y Leonardo Moya, serán los encargados de coordinar con ellos todo lo relacionado con este asunto (…)” (ver prueba).
“(…) Como parte del seguimiento al acuerdo de referencia, adjunto encontrará informe presentado por la Subgerencia de Gestión de Sistemas Periféricos, memorando SG-GSD-2018-00616, conocido en la sesión ordinaria de Junta Directiva N° 2019-08, celebrada en fecha 19 de febrero 2019. Según se desprende del estudio técnico adjunto, previo asumir el acueducto se debe cumplir con los requisitos establecidos en el informe técnico. Cualquier información adicional la pueden coordinar con la Región Pacífico Central (…)” (ver prueba).
“(…) Conclusiones 1- La zona presenta un desarrollo residencial en quintas. 2- El pozo del expediente 20209PA está en trámite de amnistía de pozos sin número y no cuenta con la concesión de aprovechamiento de agua otorgada. 3- El agua del pozo es utilizada ilegalmente.4- El pozo es utilizado para el abastecimiento público (poblacional) de al menos 65 propiedades, a pesar de haber sido solicitado para un uso de abrevadero. 5- No existen concesiones a Nombre317 de Tyrica S.A. 6- La sociedad Tyrica S.A, realiza cobros a los propietarios de las quintas por el servicio de agua. Recomendaciones: 1- Proceder con la denuncia ante la Fiscalía por el delito de usurpación del agua. 2- Informar a ARESE del cobro ilegal del servicio público. 3- Girar con la orden de sellado del pozo, debido a las inconsistencias del expediente e irregularidades el uso (…)” (ver informe y prueba).
Que en casi todas las propiedades de las calles conocidas como Dirección2419, Dirección2417 y el Higuerón cuentan con medidor y que el cobro del servicio de agua está a cargo de la empresa privada TYRICA S.A.. Que se denotaba que el pozo es para uso poblacional distinto al solicitado y que había lucro por venta del servicio. Por consiguiente, a tenor de lo dispuesto en el Decreto Ejecutivo No. 35884-MINAE (Reglamento de Perforación del Subsuelo para la Explotación y Aprovechamiento de Aguas Subterráneas) se dispuso el cierre y sellado del pozo. Adicionalmente, se solicitó la remisión de varia documentación tocante al cierre del pozo en el plazo de treinta días y se indicó que no se podía realizar ningún tipo de uso del pozo, sin obtener la concesión para el aprovechamiento del agua (ver prueba).
“(…) CONSIDERANDOS PRIMERO: Que de conformidad con la Ley de Aguas No. 276 del 26 de agosto de 1942, el Ministerio de Ambiente, Energía y Telecomunicaciones le corresponde disponer y resolver sobre su dominio, aprovechamiento, utilización, gobierno y vigilancia. SEGUNDO: Que el Decreto Ejecutivo 35669-MINAET publicado en la Gaceta 3 del 6 de enero de 2010, modificado mediante decreto 36437-MINAET del 24 de enero del 2011, delega a la Dirección de Aguas del MINAET, la competencia de admitir, tramitar y resolver sobre solicitudes de perforación del subsuelo para la exploración y explotación de aguas subterráneas y asignar el número de pozo respectivo. TERCERO: Que el Reglamento de Perforación del Subsuelo para la Exploración y Aprovechamiento de Aguas Subterráneas, Decreto Nº 35884-MINAET, regula todo lo referente a la perforación del subsuelo con fines de exploración y aprovechamiento de aguas subterráneas.
CUARTO: Que mediante informe DA-UHTPCOSJ-2123-2020, del 28 de septiembre del 2020, suscrito por José Ricardo Hidalgo Sánchez y la ingeniera Marilyn Mora Vega, coordinadora de la Unidad Hidrológica Tárcoles-Pacífico Central, se tiene por probado que el pozo encontrado en finca folio real 377663-000, en el Dirección2418 , a Nombre317 de GANADERA LA CEIBA S.A., cédula jurídica CED5632, fue perforado sin contar con los permisos correspondientes por parte del Ministerio de Ambiente y Energía y que se encuentra en la actualidad siendo aprovechado, dándosele un uso de consumo humano (poblacional) esto para abastecer el proyecto residencial Quintas La Ceiba, siendo el abastecimiento a poblaciones, un uso que reviste servicio público y es competencia del Instituto Costarricense de Acueductos y Alcantarillados o sus entes delegados por ley, por lo que en el citado oficio se ordenó su sellado, como lo establece el Decreto Ejecutivo 35884-MINAET.
QUINTO: Que el Reglamento de Perforación del Subsuelo para la Exploración y Aprovechamiento de Aguas Subterráneas, Decreto Nº 35884-MINAET en el artículo 28 indica inciso b) indica lo siguiente: “Artículo 28. - De los criterios para el cierre de pozos. La Dirección de Agua del MINAET ordenará el cierre de un pozo en las siguientes condiciones: b) Cuando se realicen perforaciones sin el debido permiso. SEXTO: Que igualmente el Reglamento de Perforación del Subsuelo para la Exploración y Aprovechamiento de Aguas Subterráneas, Decreto Nº 35884-MINAET, indica en el artículo 38 lo referente al cierre de pozos y los responsables, el cual reza lo siguiente: “Artículo 38. - Del cierre de pozos. Corresponde a la Dirección de Agua del MINAET indicar sobre el cierre y sellado de los pozos. Los costos y gastos de este procedimiento serán cubiertas por el dueño de la propiedad donde se localice el pozo; y subsidiariamente la perforadora que realizó la perforación y el geólogo responsable de esta, cuando se compruebe su actuación en el desarrollo del pozo.
El sellado debe realizarse con tapa metálica, utilizando material impermeable y hermético para asegurar el no ingreso de posibles agentes contaminantes y chorrear una losa de concreto sobre el sitio de la perforación, debiendo levantar acta notarial que así lo consigne, todo conforme lo disponga la resolución de la Dirección.” (El subrayado y resaltado no corresponden al original). SÉTIMO: Que es claro que el pozo citado no contó con los permisos correspondientes, razón por la cual se enmarca dentro de los presupuestos de la normativa invocada, dictándose la orden de sellado en apego a esta. OCTAVO: Que en fecha 20 de marzo del 2020, se presentó la solicitud de registro de pozos realizados sin permiso y habilitación de concesión de aguas subterráneas, amparados en el Decreto Ejecutivo 41851-MP-MINAE-MAG, por parte de GANADERA LA CEIBA S.A., proceso que se encuentra suspendido en razón de la ACCIÓN DE INCONSTITUCIONALIDAD, expediente 19- 017936-0007-CO, por lo que no se puede resolver dicha solicitud hasta tanto ese máximo tribunal no resuelva lo correspondiente.
NOVENO: Interesa indicar que la fuente correspondiente a pozo perforado para extracción y aprovechamiento de aguas subterráneas está en finca propiedad de GANADERA LA CEIBA S. Nombre312. y que esta empresa gestiono la inscripción del pozo en el reciente proceso de amnistía de conformidad con el Decreto 41851-MP-MINAE-MAG, pero que no se puede entrar a conocer por el fondo en razón de la acción de inconstitucionalidad citada antes. Si bien esta empresa gestionó como propietaria del inmueble la legalización del pozo sin número en expediente 20209-P, quien utiliza el agua es [...], cédula jurídica [Valor CED185]. Asimismo, consta en el expediente [Valor 003], según consta en los oficios JD-2019- 00063 del 22 de febrero de 2019, para asumir el acueducto mediante la coordinación con la Región Pacífico Central de A y A.
POR TANTO El DIRECTOR DE AGUA RESUELVE SE SUSPENDE LA ORDEN DE SELLADO del pozo perforado dictada por oficio DA-UHTPCOSJ-2123-2020, del 28 de septiembre del 2020, hasta que se encuentre resuelta la ACCIÓN DE INCONSTITUCIONALIDAD, expediente de la Sala Constitucional número 19-017936-0007-CO. Apersonarse ASOCIACIÓN DE VECINOS QUINTAS LA CEIBA TIERRA DORADA, cédula jurídica [Valor CED185]. Asimismo, consta en el expediente [Valor 003], según consta en los oficios JD-2019- 00063 del 22 de febrero de 2019, para asumir el acueducto mediante la coordinación con la Región Pacífico Central de A y A. La inscripción del pozo estará condicionada a que en estudio del expediente 20209 PA se tenga por cumplido los términos técnicos y legales estipulado en el Decreto 41851-MP-MINAE-MAG y que se entrará a conocer conforme una vez que la Sala Constitucional resuelva a acción de constitucionalidad sobre este decreto.
Según este resultado, deberá el A y A solicitar el trámite respecto ante la Direccion de Agua. Contra esta resolución cabrán los recursos ordinarios de revocatoria y apelación, dentro de los tres días hábiles siguientes a la notificación de la presente resolución, de conformidad con los artículos 343,346 y 347 de la Ley General de la Administración Pública, ambos ante este Despacho. Notifíquese al AYA, señora Yamileth Astorga Espeleta, Presidenta Ejecutiva y Licda. Cecilia Martínez, Subgerente Gestión de Sistemas Comunales y a la Unidad Hidrológica Tárcoles - Pacífico Central (…)” (ver prueba).
IV.EN CUANTO a la acción de inconstitucionalidad tramitada conforme el expediente No. 19-017936-0007-CO. En lo que respecta a este proceso –en virtud del cual se suspendió la tramitación de la solicitud planteada en marzo de 2020 para registrar el pozo bajo estudio–, se tiene lo siguiente:
“(…) Por unanimidad se declara sin lugar la acción respecto de la supuesta autorización expresa para no acudir a SETENA para valorar pozos irregulares, el alegato de riesgo de salinización o contaminación por intrusión salina, y la argüida inefectividad galopante del derecho ambiental. Por mayoría se declara sin lugar la acción de inconstitucionalidad en cuanto a los artículos 1, 2 y 3 del decreto ejecutivo 41851-MP-MINAE-MAG, Reglamento de registro de pozos sin número y habilitación del trámite de concesión de aguas subterráneas, siempre y cuando se interprete que dichos numerales no modifican los tipos penales contemplados en los artículos 226 y 227 del Código Penal; de este modo, le corresponderá al juez penal competente la determinación de la responsabilidad penal. El magistrado Rueda Leal da razones diferentes acerca del agravio antedicho. Por mayoría se declara sin lugar el recurso, en cuanto a la alegada inexistencia de un balance hídrico integral y la autorización para alterar los ciclos vitales de la biodiversidad sin mediar estudios, la falta de medidas de protección, mitigación o prevención de daños, y el derecho a la participación ciudadana.
Los magistrados Cruz Castro y Rueda Leal salvan parcialmente el voto y declaran con lugar la acción por violación al derecho a la participación ciudadana. El recurrente acude a esta Sala Constitucional e indica que figura como Presidente de [...]. Expone que hace 23 años se desarrolló el proyecto denominado Quintas Residenciales La Ceiba, el cual se compone de quintas de aproximadamente 7.000 metros cuadrados cada una y tiene un total de 100 fincas inscritas como predios agrícolas.
Indica que el desarrollador de ese proyecto era la empresa Ganadera La Ceiba S.A., la que entregó a los compradores los planos catastrados que cumplían con las especificaciones de los predios agrícolas y con el servicio de agua potable. Explica que, al momento de la venta de los inmuebles, el desarrollador garantizó la prestación del servicio de agua potable mediante un acueducto de la misma empresa, para lo cual cada parcela contaba con el respectivo medidor. Señala que inicialmente el servicio se brindaba de forma privada por la misma compañía vendedora (Ganadera La Ceiba S.A.), a través de una empresa relacionada llamada SERINCON S.A., que tuvo a su cargo el cobro del servicio. Refiere que SERICON S.A. desde el año 1997 ha suministrado el servicio de agua potable. A partir del año 2017, los depósitos de pago por el suministro de agua se realizan a otra empresa llamada TYRICA S.A., también relacionada con la Ganadera La Ceiba S.A..
Agrega que un vecino presentó una queja ante el MINAE por el alto costo del servicio de agua potable, la cual originó la emisión del oficio No. DA-UHTPCOSJ-2123-20 de 28 de septiembre de 2020 que hizo referencia a la ilegalidad del citado pozo y dispuso su cierre en el plazo de un mes.
Acusa que el MINAE dispuso el cierre de ese pozo de forma intempestiva, sin otorgar audiencia previa a todos los vecinos del residencial (pues solo se notificó a la empresa infractora) y sin realizar un debido procedimiento, quedando así todos en indefensión. Sostiene que los referidos vecinos se enteraron de lo ocurrido por terceras personas.
Alega que, tampoco, se les brindó audiencia previa o consultó a las autoridades del ICAA y de la ARESEP, como medio para buscar una solución a la situación. Todo esto, pese a que, al momento del cierre se encontraba en plena vigencia la emergencia nacional por COVID-19, por lo que, en su criterio, resulta esencial contar con el servicio de agua potable.
Añade que a pesar de que el Instituto Costarricense de Acueductos y Alcantarillados es el órgano que debe realizar y promover el planeamiento, financiamiento y desarrollo, así como resolver todo lo relacionado con el suministro de agua potable en el país, no se han tomado las acciones pertinentes para dar una solución a las 100 familias que se han visto afectadas con el cierre del pozo y la suspensión del servicio de agua en sus viviendas. Expone que el ICAA no puede quedar al margen de las gestiones necesarias a realizar para proveer el suministro de agua potable a la comunidad y por eso es necesario su concurso en esta solución; concurso que debió ser procurado por el mismo MINAE antes de ordenar el cierre del pozo.
De otra parte, reitera que el desarrollador, al poner en venta las fincas, ofreció la prestación del servicio de agua potable, factor que incidió para que las personas adquirieran las propiedades. Indica que las tres empresas supra citadas son las que tienen el poder y la administración de dicho pozo, así como tienen a su cargo la lectura de los hidrómetros, establecen las facturas y cobran por el servicio de agua, por lo que estima que es necesario que estas participen en el procedimiento de traslado del acueducto al ICAA. En ese mismo sentido, considera, tienen que coordinar con el MINAE y el ICAA lo pertinente para que se cumplan los requisitos exigidos para que dicho instituto asuma la administración del acueducto de la comunidad.
Sostiene, entonces, que en este caso se violentó el derecho de acceso al agua potable, así como sus derechos a la defensa y al debido proceso. Por consiguiente, solicita que este amparo se acogido y, entre otros aspectos, se anule la orden de cierre del pozo dispuesta en el oficio No. DA-UHTPCOSJ-2123-20 de 28 de septiembre de 2020 emitido por la UH-Tárcoles-Pacífico Central de la Dirección de Agua del MINAE. Además, que se ordene al ICAA su inmediata intervención para garantizar a los vecinos el abastecimiento regular de agua potable, realizando las gestiones y obras que fueran necesarias.
Visto lo anterior, esta Sala observa que el accionante formula este amparo dirigido en los siguientes sentidos: a) que mediante el oficio No. DA-UHTPCOSJ-2123-20 de 28 de septiembre de 2020 de la Dirección de Agua del MINAE se ordenó el cierre del pozo que abastece el complejo residencial, donde habitan 100 familias, en claro quebranto al derecho de acceso al agua potable y pese a estar vigente la pandemia por COVID-19; b) que dicha decisión se tomó sin notificarse u otorgarse audiencia previa a las 100 familias propietarias de las mencionadas quintas y, por ende, sin respetarse el debido proceso; c) que de previo a emitirse la referida orden, no se realizó consulta al ICAA o a la ARESEP, con el fin de buscarse una solución a la referida problemática; d) que las autoridades del ICAA, pese a las gestiones que le han sido formuladas, no han brindado una solución a la situación y e) que las privadas involucradas en este asunto, deben hacerse responsables y solventar el problema expuesto.
Ahora bien, analizados los agravios expuestos por el recurrente, los informes rendidos bajo la solemnidad de juramento por las autoridades recurridas, así como todas las pruebas allegadas a los autos, este Tribunal Constitucional no considera que exista mérito alguno para acoger este amparo y, concomitantemente, las pretensiones plantadas por el tutelado. Lo anterior, por los motivos que se expondrán a continuación.
A. Sobre lo dispuesto en el oficio No. DA-UHTPCOSJ-2123-20 y la necesidad de proveerse de agua potable durante la pandemia por COVID-19. En primer término, resulta menester apuntar que, en la especie, esta Sala no observa, de ningún modo, que la actuación reclamada por el accionante, sea el cierre y sellado del pozo ubicado en la finca No. 377663-000 (propiedad de Ganadera La Ceiba S.A.) y que ha abastecido desde hace varios años al proyecto denominado Quintas Residenciales La Ceiba, se pueda tener como arbitraria o infundada. En este asunto se ha demostrado, con meridiana claridad, que a los propietarios de las fincas ubicadas en el citado complejo residencial se les ha suministrado el servicio de agua –al parecer presuntamente por así haber sido dispuesto por la citada empresa desarrolladora Ganadera La Ceiba S.A.–, a través de un pozo construido de forma ilegal, es decir, respecto al cual no se tramitaron ni se solicitaron oportunamente los respectivos permisos y que, por ende, no se encuentra debidamente registrado ante la Dirección de Agua del MINAE, tal y como lo dispone el ordenamiento jurídico (Decreto Ejecutivo No. 35884-MINAE Reglamento de Perforación del Subsuelo para la Explotación y Aprovechamiento de Aguas Subterráneas); de ahí que, se haya procurado su cierre. Nótese que este último cuerpo normativo, en su artículo 28 establece lo siguiente:
“De los criterios para el cierre de pozos. La Dirección de Agua del MINAET ordenará el cierre de un pozo en las siguientes condiciones:
Lo anterior, sustenta entonces, claramente, la actuación de la Dirección de Agua del MINAE, concretamente, lo dispuesto en el oficio No. DA-UHTPCOSJ-2123-20 de 28 de septiembre de 2020 impugnado por el promovente, en su condición de Presidente de [...]. Oficio que, además, cabe destacar, señala puntualmente todos los motivos de derecho y de hecho que fundamentan el cierre en cuestión, entre los que figuran, principalmente, como se dijo, el funcionamiento del pozo de manera ilegal y su uso para consumo humano y no como abrevadero para 20 reses, tal y como se señaló y solicitó años después, concretamente en marzo de 2020, al ser presentada una gestión por la referida sociedad para legalizar el pozo, a tenor de lo dispuesto en el Decreto Ejecutivo No. 41851-MP-MINAE-MAG de 18 de julio de 2019 denominado Reglamento de registro de pozos sin número y habilitación del trámite de concesión de aguas subterráneas (procedimiento último tramitado conforme el expediente No. [Valor 003]).
Siendo así, es evidente que los propietarios de las fincas ubicadas en el citado complejo residencial se han proveído de agua de forma irregular por varios años y que las autoridades de la Dirección de Agua del MINAE, únicamente se ha abocado a regularizar y poner a derecho esa situación conforme lo establece y exige, a su vez el ordenamiento jurídico; de ahí que, bajo esa perspectiva, no podría afirmarse que la actuación de cierre y sellado del pozo en cuestión atente contra el derecho fundamental de acceso al agua potable. Por el contrario, a tenor de lo estipulado en dicho ordenamiento jurídico, tal actuación busca proteger el recurso hídrico.
De otra parte, debe tomarse en cuenta que, si bien a través del cuestionado oficio No. DA-UHTPCOSJ-2123-20 se dispuso el cierre y sellado del pozo, lo cierto es que –tal y como también quedó acreditado–, esta orden no fue ejecutada en aquel momento (sea, el año 2020) ni subsiguientemente por las autoridades de la Dirección de Agua del MINAE. Nótese que, en un primer momento, el Director de Aguas del MINAE, mediante resolución No. DA-1769-2020 de las 08:17 hrs. de 3 de diciembre de 2020 (emitida dentro del referido procedimiento No. [Valor 003]), dispuso la suspensión de dicha orden hasta tanto se resolviera la acción de inconstitucionalidad que se había presentado en contra de lo dispuesto en el citado Decreto Ejecutivo No. 41851-MP-MINAE-MAG (que permitía legalizar pozos perforados de forma irregular). Adicionalmente, en esa oportunidad, se aclaró que la inscripción del pozo solicitado quedaba sujeta al cumplimento de lo dispuesto en dicho cuerpo normativo (Decreto Ejecutivo No. 41851-MP-MINAE-MAG) y que esta solicitud propiamente sería resuelta al pronunciarse la Sala Constitucional sobre dicho proceso de constitucionalidad.
Esta última acción, según se acreditó, fue resuelta y desestimada por esta jurisdicción constitucional mediante la Sentencia No. 2021-25386 de las 13:10 hrs. de 10 de noviembre de 2021, la cual, además, fue notificada en el mes de marzo de 2022 a todas las partes. Luego, las autoridades de la Dirección de Agua del MINAE, concretamente, en el mes de julio de 2022, informaron a esta Sala que, para entonces, la solicitud para legalizar el pozo en cuestión se encontraba aún pendiente de resolver, lo cual se haría hasta que se resolviera el presente proceso de amparo. Esta situación, según se confirmó recientemente (sea, el 29 de septiembre de 2023), es la que perdura e impera a la fecha. Además, se aclaró que el pozo ubicado en el citado proyecto denominado Quintas Residenciales La Ceiba no había sido sellado y que, por ende, los habitantes de este sitio continúan utilizándolo para proveerse de agua.
En consecuencia, a partir de lo anterior, no podría sostenerse que el recurrente y el resto de personas propietarias de las quintas referidas, se hayan quedado desprovistas del servicio de agua potable, al menos, durante los años en que la pandemia por COVID-19 se encontró mayormente vigente y, por consiguiente, cuando más necesario se hizo el suministro de este líquido en resguardo del derecho fundamental a la salud.
B. En cuanto a la presunta violación al derecho a la defensa y al debido proceso. En este asunto se ha acreditado y verificado que el pozo en cuestión se halla en un inmueble propiedad de la empresa denominada Ganadera La Ceiba S.A., lo cual fue confirmado en una inspección realizada por las autoridades de la Dirección de Agua del MINAE en septiembre del año 2020, y no en un inmueble a Nombre317 propiamente de la amparada Asociación de Vecinos Quintas La Ceiba Tierra Dorada o bien a Nombre317 de algún otro vecino en particular. De ahí que, resulte plenamente justificado que las autoridades de la Dirección de Agua, el 4 de noviembre de 2020, hayan notificado el referido oficio No. DA-UHTPCOSJ-2123-20 precisamente al dueño o representante del inmueble donde se construyó y opera el pozo , pues es este quien –a tenor de lo dispuesto en el ya citado Decreto Ejecutivo 35884-MINAE Reglamento de Perforación del Subsuelo para la Explotación y Aprovechamiento de Aguas Subterráneas-, debía proceder con el respectivo cierre y sellado. Nótese que, sobre el particular, este último decreto dispone en su artículo 38 lo siguiente:
“Del cierre de pozos. Corresponde a la Dirección de Agua del MINAET indicar sobre el cierre y sellado de los pozos. Los costos y gastos de este procedimiento serán cubiertas por el dueño de la propiedad donde se localice el pozo; y subsidiariamente la perforadora que realizó la perforación y el geólogo responsable de esta, cuando se compruebe su actuación en el desarrollo del pozo. El sellado debe realizarse con tapa metálica, utilizando material impermeable y hermético para asegurar el no ingreso de posibles agentes contaminantes y chorrear una losa de concreto sobre el sitio de la perforación, debiendo levantar acta notarial que así lo consigne, todo conforme lo disponga la resolución de la Dirección.” (El subrayado no forma parte del original).
Paralelamente a lo anterior, debe tenerse claro en este asunto que la Dirección de Agua del MINAE no es o figura como el proveedor de servicio de agua potable en el complejo residencial bajo estudio. En ningún momento ha suscrito alguna especie de relación por ese concepto con ninguno de los propietarios de las 100 fincas a las que hace referencia el tutelado; de hecho, no tiene competencia alguna al respecto dotada por nuestro ordenamiento jurídico. Por consiguiente, no podría imputársele a esta dirección la obligación de notificarle a cada uno de estos propietarios (en presunta calidad de beneficiarios del servicio de suministro de agua), lo dispuesto en el citado oficio No. DA-UHTPCOSJ-2123-20. Resulta evidente que la Dirección de Agua se limitó a poner a derecho el uso del pozo y, desde esa perspectiva, su labor se reducía a notificarle al propietario del inmueble donde este se hallaba, la orden de cierre y sellado en cuestión, tal y como así efectivamente se hizo. Así las cosas, en este caso, no es factible afirmar que a los dueños de los citados inmuebles que conforman el citado residencial, se les vulneraron sus derechos a la defensa y al debido proceso.
En todo caso, es importante destacar que el propio recurrente, en el escrito de interposición de este amparo, afirmó que los propietarios de los inmuebles ubicados en el citado complejo residencial se enteraron de la orden de cierre en cuestión por otros medios. Incluso, en el elenco de pruebas aportadas por el promovente, consta algunos oficios fechados 17 de noviembre de 2020, donde se acredita que un representante de la sociedad Ganadera La Ceiba S.A. les notificó a algunos dueños de las quintas la orden de sellado dispuesto en el citado oficio No. DA-UHTPCOSJ-2123-20 de 28 de septiembre de 2020. Siendo así, es claro que los propietarios de los citados inmuebles, de previo a la interposición de este amparo, sí tuvieron conocimiento de la orden de cierre del pozo que los abastecía de agua, lo que, en consecuencia, les permitió ejercer, en aquel momento, las acciones que estimaran pertinentes con el fin de regularizar la situación bajo estudio.
De hecho, es importante señalar que en este asunto ha quedado plenamente verificado –pues así lo ha relatado el propio recurrente en el escrito de interposición de este proceso–, que los vecinos del mencionado residencial ya conocían, desde muchos años atrás (al menos desde el año 2013), la situación irregular en la que se encontraban respecto a la prestación el servicio de agua (dado que el pozo funcionaba ilegalmente), al punto que, en los años 2016 y 2018, buscaron ayuda de las autoridades del ICAA para que asumieran el acueducto que opera en el sitio. Por consiguiente, es claro que la orden de cierre dispuesta en septiembre de 2020 por parte de la Dirección de Agua no podría considerarse como intempestiva y arbitraria, según los términos expuestos y alegados ante este Tribunal, pues era de esperarse que las autoridades del MINAE, tarde o temprano, actuaran de esa manera, siguiendo, como se ha dicho reiteradamente, lo dispuesto por nuestro ordenamiento jurídico (Decreto Ejecutivo No. 35884-MINAE).
C. Tocante a la presunta obligación de coordinar previamente con la ARESEP y el ICAA. Siguiendo lo indicado en el apartado anterior, esta Sala es del criterio que la Dirección de Agua del MINAE, a tenor, a su vez, de lo dispuesto en el ya citado Decreto Ejecutivo No. 35884-MINAE, cumplió con su puntual obligación de notificar el cierre del pozo al dueño del inmueble donde este se encuentra, sin que se denote o se imponga en ese mismo cuerpo normativo, la obligación de llevar a cabo la actuación que reclama la parte accionante, sea la de coordinar de previo al cierre del pozo con otras instituciones (en este caso con la ARESEP y con el ICAA), con el fin de hallar una solución al problema de suministro de agua en el complejo residencial. El promovente lo que sugiere en el fondo, a través de este alegato, es que el MINAE debía suspender indefinidamente el cumplimiento de lo dispuesto en la citada normativa (y perpetuar el uso y funcionamiento de un pozo construido ilegalmente), hasta que alguna de esas dos instituciones, principalmente el ICAA, resolviera totalmente la situación en la que se encontraron y encuentran actualmente los vecinos del citado residencial, por motivos, al parecer, ajenos a la administración pública, lo cual sin embargo, no resulta plausible en criterio de este órgano constitucional, ya que el deber de este ministerio era velar por el cierre del pozo y no otro. Esto, pues como se ha dicho, la Dirección de Agua del MINAE no ha intervenido, en ningún momento, como prestador del servicio de agua potable en los inmuebles bajo estudio.
En todo caso, como ya también se dijo, en este asunto consta que desde al menos el año 2016, sea, cuatro años antes de emitido el oficio en cuestión No. DA-UHTPCOSJ-2123-20, el ICAA conocía del caso bajo estudio –pues así le fue puesto en conocimiento por miembros de [...]–, sin que, en ese momento, se haya logrado concretar una solución. Además, se acreditó que dos años más tarde, sea, en septiembre de 2018, el recurrente presentó ante la Junta Directiva del ICAA una solicitud formal para que esa institución administrara el suministro de agua potable en el referido proyecto habitacional, lo cual, sin embargo, no se pudo realizar ante la falta de cumplimiento de los requisitos establecidos al efecto de parte de los interesados. Por ende, en este asunto se ha verificado fehacientemente que si bien el MINAE al emitir el acto administrativo bajo estudio no realizó esa coordinación previa pretendida por el accionante (la cual, como se dijo, en todo caso no le es impuesta por el ordenamiento jurídico), lo cierto es que para entonces el ICAA conocía el problema bajo estudio y ya había emitido criterio sobre cómo se podría resolver la situación (tema último que se retomará con detenimiento en el siguiente apartado).
D. Sobre la supuesta omisión del ICAA en solventar la situación relacionada con el suministro de agua potable en el complejo residencial. Contrario a lo acusado por el recurrente, este Tribunal Constitucional no considera que a las autoridades del ICAA se les pueda imputar o atribución alguna actuación u omisión arbitraria de su parte en este asunto, que haya atentado en contra de los derechos fundamentales de los habitantes de Quintas Residenciales La Ceiba. Debe observarse que, en este asunto, como ya se adelantó, consta que los interesados (vecinos de dicho residencial), han acudido en dos ocasiones ante esta institución y que, si bien esta no ha asumido el acueducto y, consiguientemente, el suministro de agua potable en dicho complejo residencial, esto se debe a una importante razón, y es que los primeros no han cumplido una serie de requisitos y aspectos técnicos que les fueron notificados y puestos en conocimiento desde hace varios años.
En concreto, se determinó que, en el año 2016, algunos miembros de [...] se reunieron con dos ingenieros del ICAA para proponerles asumir el acueducto del complejo residencial. En esta ocasión, según se acreditó también, dichos funcionarios solicitaron el cumplimiento de varios requisitos para tal efecto (v.gr. información detallada de la prueba de bombeo, la cantidad de agua que daba el pozo, análisis de calidad de agua, el plano de la finca donde está el pozo y posible servidumbre, etc.). Asimismo, se verificó que, tiempo después, en septiembre del año 2018, el recurrente presentó ante la Junta Directiva del ICAA una solicitud formal para que esa institución administrara el suministro de agua potable en el referido proyecto habitacional. Dicha solicitud fue trasladada por la Junta Directiva del ICAA a la Subgerencia de Gestión de Sistemas Delegados del ICAA, producto de lo cual se emitió el informe No. GSP-RPC-2018-00586 de fecha 16 de octubre de 2018, llamado Informe técnico Quintas La Ceiba Tierra Dorada, suscrito por un funcionario de la Región Pacífico Central del ICAA y en el cual se indicó que, para acceder a la pretensión del gestionante, se debían cumplir una serie de requisitos, entre estos, lo siguientes:
“(…) 1. Visado de la segregación de la finca, conforme a lo dispuesto en el artículo 36 de la Ley de Planificación Urbana y en los artículos 11.2.1 y 50, 51, 52, 53, 54 y 55 del Reglamento Nacional para el Control del Fraccionamiento y Urbanización, estos últimos cinco artículos en lo correspondiente a parcelamiento agrícola; como excepcionalidad, requiriendo para ello el visado del INVU. Todo lo anterior para que la prestación del servicio sea legal, ambiental y técnicamente factible.
2. El servicio a suministrar debe ser adecuado en cuanto a calidad, cantidad y continuidad, por lo que la infraestructura lo debe permitir, así como un remanente para crecimiento vegetativo de la zona.
3. Las calles internas del proyecto deben ser calles públicas o servidumbres agrícolas, debiendo estar inscritas las primeras como tales dentro de la red vial cantonal de Orotina, mientras las segundas como servidumbres de paso y acueducto a favor del AyA, que permitan la libre circulación por ellas, así como la posibilidad de instalación de infraestructura.
4. La red de distribución existente debe ser evaluada en cuanto a sus características como diámetro, material, cédula, instalación y cualquier otro elemento que debe ser considerado para su posible aceptación, o en su defecto, que deba ser sustituido. Estas tuberías deben cumplir con la Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial.
5. Tal y como lo establece la solicitud, la infraestructura requerida debe ser completa, incluyendo el pozo totalmente equipado y con la protección necesaria, las áreas de protección que establezca el estudio hidrogeológico, prueba de bombeo de 72 horas, lo cual es necesario realizar, y toda la información disponible y por obtener de él. Así mismo debe incluir el sistema de desinfección, tuberías de impulsión, tanque de almacenamiento y red de distribución.
6. Toda la infraestructura a construir y/o existente debe ser aprobada por el AyA, de acuerdo a la normativa establecida.
7. Definir las características del desarrollo, esto es, si es de tipo turístico, habitacional, agrícola u otro.
8. Los aspectos de la instalación de la micromedición (hidrómetros) o su suministro deberá ser definido por los interesados (…)”.
Todos estos requisitos, según se informó por parte de las autoridades del ICAA e, incluso, así lo reconoció el propio accionante en el escrito de interposición de este amparo, no habían podido ser cumplidos, por lo que, consecuentemente, dicho instituto no había podido tomar el acueducto y suministrar el servicio de agua potable, según lo pretendido.
De este modo, se colige fácilmente que las autoridades del ICAA no se han negado, en ningún momento, de forma infundada o arbitraria a prestar el servicio bajo estudio, según los términos en que lo hace ver o expone el tutelado ante esta jurisdicción constitucional. Lo que sucede en este asunto es que el ICAA, de previo a realizar la actuación pretendida, requiere que se cumplan una serie de requisitos en apego a lo estipulado en el ordenamiento jurídico, sin que sea posible para este caso en particular, realizar una ilegal excepción, y brindar el servicio en el proyecto denominado Quintas Residenciales La Ceiba, tal y como pareciera así lo quiere el recurrente. Nótese que, esta Sala, en reiteradas oportunidades, ha señalado que la prestación del servicio de suministro de agua potable se puede válidamente denegar cuando no se han cumplido los requisitos estipulados al efecto. Así, en el Voto No. 2009-9936 de las 14:08 hrs. de 19 de junio de 2009, se indicó lo siguiente:
“(…) De tal forma, este carácter de derecho fundamental no implica un acceso irrestricto a los servicios de agua, ya que la administración válidamente puede establecer requisitos generales de necesario cumplimiento por cada solicitante para valorar su particular requerimiento, por lo que se reconoce la posibilidad de limitar el otorgamiento de nuevas pajas de agua con el propósito de asegurar la continuidad de la prestación del servicio público de suministro de agua potable a los actuales usuarios y domicilios que reciben dicho servicio –ver sentencias números 2007-17475, de las once horas cinco minutos del treinta de noviembre de dos mil siete, y 2008-11390, de las once horas veintinueve minutos del veintidós de julio de dos mil ocho-. En este sentido, en sentencia número 2006-1898, de las nueve horas cincuenta y tres minutos del diecisiete de febrero de dos mil seis –reiterada, entre otras, por sentencia número 2007-13310, de las diez horas cincuenta y siete minutos del catorce de setiembre de dos mil siete- estableció la Sala que:
“El recurrente alega (…) que pese a las solicitudes y esfuerzos hechos, el Instituto recurrido se ha negado a brindarles el servicio de agua potable aduciendo que se trata de un precario y que sus habitantes no cuentan con un plano de segregación que establezca que son propietarios de los inmuebles. Al respecto, se encuentra acreditado en autos, con base en el informe rendido bajo juramento por la autoridad recurrida, que existe una imposibilidad para instalar servicios de agua potable domiciliaria en la comunidad que habita el recurrente por dos motivos específicos: la falta de una infraestructura adecuada y de presentación de solicitudes con cumplimiento de requisitos legales por parte de los interesados (...). Esta Sala, en la sentencia No. 2004-12185 de las 13:31 horas del 29 de octubre del 2004, en un caso similar al presente, señaló que no era posible obligar al Instituto Costarricense de Acueductos y Alcantarillados a eludir lo dispuesto en su Reglamento de Prestación de Servicios a los Clientes ni en la Ley General de Agua Potable.
De ahí que, en el tanto el amparado, no reúna las condiciones y requisitos ahí exigidos, aunque el servicio de agua potable debe estar al alcance de toda persona por tratarse de un servicio esencial, no se le puede proveer de manera regular. Dada la existencia de esos dos motivos objetivos por los cuales no es posible suministrar un servicio de agua potable regular al accionante: su falta de cumplimiento de requerimientos para la conexión de un servicio nuevo, empezando, por la presentación de la solicitud y la existencia de una infraestructura adecuada en la zona, no existe motivo alguno para entender que la denegatoria de la prestación del servicio regular por parte del Instituto recurrido se deba al hecho que el amparado y sus vecinos no cuentan con títulos de propiedad sobre los inmuebles que poseen. A lo anterior cabe agregar que con base en el artículo 33 del Reglamento referido, la falta de un título de propiedad no parece ser un obstáculo para solicitar la conexión de un servicio nuevo de agua potable, en tanto se cumplan los requerimientos que indica esa norma.
En todo caso, se encuentra acreditado también que aunque no se ha suministrado el servicio regular de agua potable, el recurrente y demás vecinos cuentan con fuente pública que el Instituto instaló para que puedan abastecerse, para sus necesidades básicas. De ahí que considere este Tribunal que ha sido la propia omisión del recurrente y de los vecinos de la localidad, quienes no acreditan haber presentado las solicitudes para la instalación de un servicio nuevo de agua potable en la comunidad donde habitan, la que ha impedido que se valore su situación a efectos de determinar si, cumpliendo, sobre todo los requerimientos del artículo 33 del Reglamento de Prestación de Servicios a los Clientes, las limitaciones de infraestructura pueden ser superadas en su caso y se les puede proveer de un servicio regular de agua potable.” Se entiende entonces, que si bien existe un derecho fundamental al agua que puede ser exigido a la administración correspondiente, la prestación del servicio bien puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a que exista posibilidad material de suministro, esto es, que no existan situaciones técnicas que imposibiliten o desaconsejen a la administración a brindar el servicio de agua potable, situación que determina que la administración carece de la obligación de prestar el servicio de agua potable en caso de existir razones técnicas que lo desaconsejen o imposibiliten, debiendo informar adecuadamente al gestionante las razones por las cuales no puede atenderse su solicitud (…)”.
Por su parte, en la Sentencia No. 2018-7781 de las 09:15 hrs. de 18 de mayo de 2018, esta Sala señaló:
“(…) III.- SOBRE LA DENEGATORIA DEL SERVICIO DE AGUA POTABLE. Esta Sala ha considerado que, si bien, existe un derecho fundamental al agua potable, su ejercicio no es indiscriminado, de forma que exista una obligación de los entes que prestan ese servicio de brindarlo en cualquier condición y oportunidad. En concreto, esta Sala ha reconocido que el Instituto Costarricense de Acueductos y Alcantarillados, las municipalidades, o bien, las asociaciones administradoras de acueductos y alcantarillados, pueden denegar la disponibilidad de agua potable si existen razones técnicas que así lo justifiquen. En sentencia número 2009-003825 de las 16:49 horas del 10 de marzo de 2009, reiterada en la sentencia No. 2016-005382 de las 9:05 horas de 22 de abril de 2016, esta Sala resolvió lo siguiente:
“(...) Se entiende entonces, que si bien existe un derecho fundamental al agua que puede ser exigido a la administración correspondiente, la prestación del servicio bien puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a que exista posibilidad material de suministro, esto es, que no existan situaciones técnicas que imposibiliten o desaconsejen a la administración a brindar el servicio de agua potable, situación que determina que la administración carece de la obligación de prestar el servicio de agua potable en caso de existir razones técnicas que lo desaconsejen o imposibiliten, debiendo informar adecuadamente al gestionante las razones por las cuales no puede atenderse su solicitud (…)”.
Concomitantemente, resulta menester traer a colación lo informado sobre el particular y bajo juramento por el Subgerente de Sistemas Periféricos del ICAA, sea, lo siguiente:
“(…) toda la información requerida por el AyA, plasmada en el informe técnico, son requerimientos esenciales para concretar la administración del acueducto por parte del AyA, por ende la Institución ha mostrado su anuencia en solventar las necesidades de abastecimiento de la comunidad, en el tanto se brinde la información solicitada, se realicen las mejoras que la parte técnica institucional determine y se defina la condición de acceso a los inmuebles y su respectivas inscripciones, todo lo anterior de acuerdo a lo establecido en el cuerpo normativo, que rige las condiciones a las que se obliga el Instituto con el usuario y los requisitos necesarios para la prestación del servicio, se encuentran en el Reglamento para la Prestación del Servicio de AyA, en el Artículo 7 (…)” (El subrayado no forma parte del original).
Además, esta autoridad sostuvo que:
“(…) si el recurrente aporta la información solicitada en el informe realizado por la Dirección de Operación y Mantenimiento desde octubre del 2018, para determinar las condiciones actuales del sistema, accesos y posteriormente realizar las mejoras indicadas por el área técnica institucional, se puede asumir el acueducto y solucionar las condiciones actuales del recurso hídrico, de los pobladores de Quinta La Ceiba (…)”. (El subrayado no forma parte del original).
Así las cosas, en este asunto se tiene por acreditado que las autoridades del ICAA no han dejado desamparados a los vecinos del referido residencial, habida cuenta que les han propuesto un proyecto para asumir el acueducto y proveerles el servicio de agua potable desde hace varios años, siendo que, si esto no se ha concretado, ha sido porque los segundos no han cumplido con los requisitos exigidos y puestos en su conocimiento.
E. En cuanto a la pretensión del recurrente para que las empresas relacionadas con el complejo residencial asuman su responsabilidad en este caso. Finalmente, resulta menester señalarle al recurrente que la pretensión dirigida a que las empresas involucradas en este asunto (principalmente, la empresa desarrolladora Ganadera La Ceiba S.A.), se hagan responsables de asumir la situación bajo estudio y brinden una solución en cuanto a la provisión del servicio de agua potable en el mencionado residencial, deberá ser planteada, si a bien lo tiene, ante las vías ordinarias de legalidad creadas especialmente al efecto. Nótese que escapa del ámbito de competencias de este Tribunal Constitucional, por tratarse de un tema de mera y pura legalidad, analizar por el fondo el caso bajo estudio, específicamente, los acuerdos a los que llegaron los propietarios de los inmuebles que forman parte del citado residencial con la empresa desarrolladora Ganadera La Ceiba S.A. (o con algún otro sujeto de derecho privado), al momento de comprar las quintas y todos aquellos puntuales aspectos relacionados propiamente con la prestación del servicio de agua en el sitio y, concomitantemente, determinar, si esta sociedad u otra deben asumir o no algún tipo de responsabilidad en la situación y caso acá expuesto.
No resulta material ni razonablemente posible entrar a un complicado y lento sistema probatorio para dilucidar los referidos aspectos señalados por la parte tutelada. Por ende, como ya se dijo, este agravio en particular debe ser planteado ante las respectivas vías ordinarias de legalidad, por cuanto claramente excede el carácter sumario del recurso de amparo, así como la competencia de este Tribunal otorgada por la Ley de la Jurisdicción Constitucional y la propia Constitución Política.
* En mérito de lo expuesto, al no advertirse, en la especie, que las autoridades recurridas hayan cometido violación alguna a los derechos fundamentales del recurrente y del resto de propietarios del proyecto Quintas Residenciales La Ceiba, lo que procede es desestimar el presente proceso de amparo.
VI.Ahora bien, pese a lo dicho supra, resulta menester indicarles a las autoridades del Instituto Costarricense de Acueductos y Alcantarillados que, en el momento que los propietarios de los inmuebles que conforman el proyecto Quintas Residenciales La Ceiba cumplan con todos los requisitos técnicos y legales que le han sido exigidos, se resuelva lo que en derecho corresponda; siempre que otra causa ajena a la examinada en el sub lite no lo impida.
VII.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
POR TANTO:
Se declara sin lugar el recurso. Tomen nota las autoridades del Instituto Costarricense de Acueductos y Alcantarillados de lo dispuesto en el considerando VI de la presente sentencia.
