Petition for amparo (recurso de amparo) filed by Nombre729, identity card No. CED231, against the MINISTERIO DE SALUD, the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS -ICAA-, the ASADA DE SANTA ROSA DE OREAMUNO DE CARTAGO, the MINISTERIO DE AMBIENTE Y ENERGÍA, the SISTEMA NACIONAL DE ÁREA DE CONSERVACIÓN, and the MINISTERIO DE AGRICULTURA Y GANADERÍA.
Findings of Fact (Resultando):
In turn, the Nombre733 entities in the northern area of Cartago requested that the governing authority conduct hydrogeological studies (estudios hidrogeológicos), which requires the respective assessments by the UEN Gestión Ambiental and the Presidencia Ejecutiva in order to channel the terms of reference and associated costs. Progress in this regard will be communicated, as a reasonable period is required to establish the timeframe, costs, resources, and responsible parties. 22. It is essential to note that, in October 2022, sampling (muestreo) of the seven water sources (fuentes de agua) belonging to the Asada de Santa Rosa was carried out as part of an interinstitutional initiative involving the Ministerio de Salud, the Laboratorio Nacional de Aguas del AyA, and the Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional (IRET-UNA), for the purpose of assessing the relevant water-quality issues (temas de calidad), as a potential solution for supplying water to the community of Cipreses de Oreamuno in response to the impacts that this community is also experiencing, which could be addressed by interconnecting the systems of the Asada de Santa Rosa, as documented in the attached documents. 23.
Based on the foregoing, it is not true that, since 2021, the Asada, the Ministerio de Salud, or AyA itself had been aware of contamination at the Asada de Santa Rosa de Oreamuno, because the sampling had not yet been conducted. 24. As indicated, it was not until October 2022 that sampling of the seven sources belonging to the Asada de Santa Rosa was carried out as part of an interinstitutional initiative, for the purpose of assessing the relevant water-quality issues, as a potential solution for supplying water to the community of Cipreses de Oreamuno in response to the impacts that this community is also experiencing, which could be addressed by interconnecting the systems of the Asada de Santa Rosa. 25. Therefore, it falls within the authority and responsibility of the Comisión Interinstitucional para el resguardo de las fuentes de agua utilizadas para consumo humano ubicadas en la zona norte de la provincia de Cartago to continue seeking alternatives to address the presence of chlorothalonil metabolites (metabolitos de clorotalonil) in five of the seven water sources belonging to the Asada de Santa Rosa, given the complexity of the case, and not solely within the authority and responsibility of the Instituto.”.
Jose Sánchez Redondo, president of the ASADA of Santa Rosa, who is immediately and expressly ordered as follows: “… Inform the community through as many media outlets as possible that the drinking-water sources NACIENTE PIEDRA, Nombre730, NACINETE BIRRIS, NACIENTE AGUA FRÍA, and NACIENTE MANUEL GRANADOS, used by the ASADA of Santa Rosa de Oreamuno, are not to be used for human consumption, food preparation, or hygiene activities. In the absence of information characterizing and identifying health risks associated with the consumption, ingestion, or any other type of contact with the metabolites, the water from these sources may not be used for human consumption, food preparation, or personal-hygiene activities, pursuant to the precautionary principle (principio precautorio). The use of water from these sources may be considered for flushing toilets and for other household cleaning and disinfection activities...” sic 2.

Sanitary order MS-DRRSCE-DARSO-OS-0106-2022 issued to Eng. Rafael Barboza Topping, Expert Director of UEN Gestión de ASADAS, Subgerencia de Gestión de Sistemas Delegados of Instituto Costarricense de Acueductos y Alcantarillados, who is immediately and expressly ordered as follows: “… Accurately and effectively communicate to the community of Santa Rosa and surrounding areas, through as many channels as possible, the situation affecting ASADA Santa Rosa concerning metabolites of the pesticide Clorotalonil and the application of the precautionary principle, in order to prevent health problems among the population; also clarify that water for human consumption, food preparation, and hygiene will come exclusively from tanker trucks, while water supplied by the aqueduct may be considered for flushing toilets and for other household cleaning and disinfection activities…”sic.
Furthermore, in response to the laboratory results reported by email by MSc. Clemens Rupert of Instituto Regional de Estudios en Sustancias Tóxicas (IRET) on Friday 17 de marzo del 2023 at 17 hours and 9 minutes, concerning the laboratory analysis reports from the second round of sampling conducted at the springs (nacientes) used by the ASADA of Santa Rosa de Oreamuno, which again showed the presence of metabolites of the fungicide Clorotalonil, this Área Rectora de Salud requested by email dated 20 de marzo del 2023 that Dr. Albin Badilla Mora, Nivel Central del Ministerio de Salud, assess the analysis results and, if necessary, determine the measures to be taken regarding the matter at issue. A response was received by email on 23 de marzo del 2023, in which Dr. Badilla Mora expressly stated: “… It is important to consider the health and well-being of the population whenever an environmental risk arises.
In the case of the Acueducto de Santa Rosa de Oreamuno, this concern has been addressed by the Ministerio, and actions are under way because residues of the chemical 1,3- dicarbamoil-2,4,5,6-tetraclorobenceno, derived from the pesticide Clorotalonil, have been found in the water, prompting sanitary orders prohibiting the population from consuming water from several systems of that aqueduct. It is also important to note that Nombre732 was not affected in the October sampling, but the November results show that it is affected. This situation indicates that the water source is contaminated and that measures must be taken to prevent its consumption by the population. Accordingly, the precautionary principle should be applied, and actions should be taken by the local Área Rectora so that the water from Nombre732 is not consumed by the population until at least 3 negative samples have been obtained.
This is necessary to ensure that the water is safe for human consumption and does not pose a risk to public health. It is important to emphasize that the Ministerio de Salud, as the governing authority for public health, must safeguard the health of the population, beginning with prevention. Therefore, coordination with the ASADA and AYA is recommended in order to implement water-quality prevention and control measures similar to those previously implemented for the other springs…” sic (folios 0343 through 0350, 0352, and 0371 through 0373 = folios 0035 through 0046). In view of the foregoing, this Área Rectora de Salud proceeded to issue and serve three administrative acts (actos administrativos) (folios 0374 through 0382 = folios 0047 through 0055) under the following consecutive numbers: 1. Sanitary order MS-DRRSCE-DARSO-OS-0023-2023 issued to Mr. Jose Sánchez Redondo, president of the ASADA of Santa Rosa de Oreamuno, who is immediately and expressly ordered as follows: “… 1) Inform the community through as many media outlets as possible that the drinking-water source Nombre732, used by the ASADA of Santa Rosa de Oreamuno, is not to be used for human consumption, food preparation, or hygiene activities. 2) Coordinate with Instituto Costarricense de Acueductos y Alcantarillados to ensure that the water supplied to the population by tanker trucks or any other means of transportation comes from another source that does not contain contaminants.
In the absence of information characterizing and identifying health risks associated with the consumption, ingestion, or any other type of contact with the metabolites, the water from this source may not be used for human consumption, food preparation, or personal-hygiene activities, pursuant to the precautionary principle. The use of water from this source may be considered for flushing toilets and for other household cleaning and disinfection activities. The foregoing is in compliance with the instructions provided by Dr. Albin Badilla Mora in the email entitled Informe laboratorio análisis muestras ASADA Santa Rosa de Oreamuno nov. 2022, sent today, 23 de marzo del 2023, and received by this Área Rectora de Salud at 09:04 hours (attached)…” sic 2. Sanitary order MS-DRRSCE-DARSO-OS-0024-2023 issued to Eng. Rafael Barboza Topping, Expert Director of UEN Gestión de ASADAS, Subgerencia de Gestión de Sistemas Delegados, and MS-DRRSCEDARSO-OS-0025-2023 issued to MSc. Vladimir Mesén Montenegro, Head of the Oficina Regional Central Este, both of Instituto Costarricense de Acueductos y Alcantarillados, who are immediately and expressly ordered as follows: “… 1) Do not use the Nombre732 water source of the ASADA of Santa Rosa de Oreamuno to supply the population, by tanker trucks or any other means of transportation, with water used for human consumption, food preparation, or hygiene activities. 2) Coordinate with MR.
JOSE SANCHEZ REDONDO, president of the ASADA of Santa Rosa de Oreamuno, to ensure that the water supplied to the population by tanker trucks or any other means of transportation comes from another source that does not contain contaminants.
In the absence of information characterizing and identifying health risks associated with the consumption, ingestion, or any other type of contact with the metabolites, the water from this source may not be used for human consumption, food preparation, or personal hygiene activities, in accordance with the precautionary principle (principio precautorio). The use of water from this source may be considered for flushing toilets and for other household cleaning and disinfection activities. The foregoing is in compliance with the instructions issued by Dr. Albin Badilla Mora in an email entitled Informe laboratorio análisis muestras ASADA Santa Rosa de Oreamuno nov. 2022, dated today, 23 de marzo del 2023, and received by this Área Rectora de Salud at 09:04 hours (attached)…” sic Por tanto, since notice of the aforementioned administrative acts (actos administrativos) was served, ASADA Santa Rosa de Oreamuno currently has only one spring (naciente) (Nombre734 ) authorized for use for human consumption, food preparation, and/or hygiene activities, since the other springs are contaminated.
In addition, through the distribution of drinking water (agua potable) by tanker trucks, pickup trucks equipped with water tanks, and the installation of storage tanks for self-consumption, it supplies its 853 customers, representing a total population of 3523 inhabitants according to the overcrowding factor (Factor de Hacinamiento) for the district of Santa Rosa de Oreamuno de Cartago, as determined by INEC in the 2011 census, thereby providing the population with water suitable for human consumption as a precautionary measure in response to the problem identified in that community (…) In addition to the foregoing, agricultural production and the use of these types of products place the groundwater and surface-water sources present in these areas at risk of contamination by the pesticide Clorotalonil and its metabolites, given its capacity for infiltration and the extensive agricultural use of that product.
According to the Ministerio de Agricultura y Ganadería in the “Plan de Manejo Remedial para implementar en fuentes de agua de la ASADA Cipreses de Oreamuno,” that molecule is found in more than 50 commercial products registered in the country and is used very widely, including, for example, on the following crops: celery, broccoli, coffee, onion, sweet pepper, cauliflower, beans, tomatoes, carrots, cabbage, potatoes, among others, many of which are grown in the northern area of the province of Cartago; accordingly, the prohibition of that pesticide plays a very important role in the search for short-, medium-, and long-term solutions. (folios expediente ASADA Cipreses 02514 al 02526 = folios 0078 al 0090). In addition, through joint work between the Dirección Regional Central Este, represented by Ing. Nelson Artavia Vega, and the Área Rectora de Salud de Oreamuno, represented by Dra. María José Lafuente González, the “Comisión Interinstitucional para el resguardo de las fuentes de agua utilizadas para consumo humano ubicadas en la Zona Norte de la provincia de Cartago” was established.
That commission is composed of representatives from ORAC Central Este AyA, UEN Gestión Ambiental AyA, Dirección de Agua, Ministerio de Agricultura y Ganadería, Comisión para el Ordenamiento y Manejo de la Cuenca Alta del Río Reventazón – COMCURE, Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía SINAC – MINAE, and Servicio Nacional de Salud Animal – SENASA. The commission’s objective is to establish a road map and work jointly to address the water-supply systems (acueductos) of the Zona Norte de Cartago, beginning with those in the cantons of Oreamuno and Alvarado. To date, 7 meetings have been held at one-month intervals, and there is now a Preventive Measures Work Plan and a Reactive Measures Work Plan, setting out a joint course of action to safeguard the water sources used for human consumption in that area. As an initial phase, the SERSA Inspection Guides, Forms and Guides for the Water Quality Monitoring Process, and Water Supply System Registry are being implemented, based on the Reglamento para la Calidad del Agua Potable, in the various water-supply systems of the cantons of Oreamuno and Alvarado.
In addition, AyA began implementing the Water Safety Plan (Plan de Seguridad del Agua) on 29 de noviembre del 2022, with the support of all members of the commission, as well as the Municipalidad de Oreamuno, Municipalidad de Alvarado, and the Nombre733 in the sector, carrying out a series of actions that constitute an important pillar for safeguarding water sources and the health of the population supplied. Additionally, in accordance with the agreements adopted at the meeting of the “Comisión Interinstitucional para el resguardo de las fuentes de agua utilizadas para consumo humano ubicadas en la Zona Norte de la provincia de Cartago,” held on 08 de febrero de 2023 (folios 0091 al 0092), official letter MS-DRRSCE-URS-0087-2023, signed by Ing. Nelson Artavia Vega and Dra. María José Lafuente González, was used to request the following, verbatim, from Dr. Oscar Bermúdez García, Director Dirección Regional de Rectoría de la Salud Central Este (folios 0093 al 0095): “…
Pursuant to the agreements adopted at the meeting of the “Comisión Interinstitucional para el resguardo de las fuentes de agua utilizadas para consumo humano ubicadas en la Zona Norte de la provincia de Cartago,” held on 08 de febrero de 2023, you are hereby informed that a considerable number of water springs in the northern area of Cartago are registered by Nombre733 and Municipal entities in the area for the supply of water for human consumption (information to be confirmed by AyA and the Dirección de Aguas, although the number is estimated to exceed 40). Because that area has been characterized by the emerging agricultural and livestock activity that has developed over the years, it is inferred that the springs are located in an area highly vulnerable to contamination. It is therefore of the utmost importance to have hydrogeological studies (estudios hidrogeológicos) to determine, in the first instance, the aquifer recharge zones (zonas de recarga acuífera) and spring protection areas (áreas de protección), as well as the potential environmental risks to which they are exposed.
It is also important to ascertain the current status of the agreement between the Laboratorio Nacional de Aguas and the Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional (IRET-UNA), as well as to conduct laboratory analyses of all water sources and the distribution network in the northern area of the province of Cartago to determine whether degradation metabolites of the pesticide Clorotalonil are present. In view of the foregoing, in order to unify criteria, follow the same course of action, and implement the agreements adopted at that meeting, together with the fact that all the springs are located in the same area and have similar characteristics, with some being very close to one another (less than one kilometer apart), we respectfully request that you use your good offices to: 1. Request that the Presidencia Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (Ing.
Alejandro Guillén Guardia) and the Gerencia General del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) (Sr. Osvaldo Quirós Arias), with a copy to the Región Central Oriental del SENARA (Ing. Eddy Romero del Valle), jointly conduct hydrogeological studies of all springs used for human consumption located in the Zona Norte de la provincia de Cartago, since both institutions bear direct responsibility for such studies. 2. Request from the Presidencia Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (Ing. Alejandro Guillén Guardia), with a copy to ORAC Central Este del AyA (Ing. Vladimir Mesen Montenegro), the existing Technical Studies (Estudios Técnicos) for all springs used for human consumption located in the Zona Norte de la provincia de Cartago. 3. Request from the Dirección del Laboratorio Nacional de Aguas (Dr. Darner Mora Alvarado) information on the progress made toward conducting laboratory analyses of the degradation metabolites of the pesticide Clorotalonil, since it is of the utmost importance to ascertain the current condition of all springs used for human consumption located in the Zona Norte de la provincia de Cartago with respect to the impact of that substance on the water supplied to the population. 5. Request from the Unidad Hidrológica Caribe de la Dirección de Aguas del MINAE (Ing. Gilberth Octavio Molina) a list of water-supply systems and water sources suitable for human consumption located in the cantons of Cartago, Oreamuno, Turrialba, and Alvarado, including their updated georeferenced locations. 6. Request support from the Dirección General de Salud in the form of a toxicology professional, for the purpose of establishing the guidelines to be followed in conducting, with academic support, studies of the effects on human health caused by consuming water contaminated with degradation metabolites of the pesticide Clorotalonil…” sic In response to the requests described above, the Dirección Regional de Rectoría de la Salud Dirección Regional Central Este proceeded to notify the parties involved, as evidenced by official letters MS-DRRSCE-0282-2023, MS-DRRSCE-0283-2023, MS-DRRSCE-0284-2023, MS-DRRSCE-0285- 2023, MS-DRRSCE-0287-2023 (folios = 0096 al 0105).
In addition to the foregoing, on 14 de diciembre del 2022, through official letter MS-DPRSA-0752-2022, signed by Ing. Eugenio Androvetto Villalobos, Ing. Ricardo Morales Vargas, Jefe Unidad de Salud Ambiental, and Dr. Albin Badilla Mora, Microbiólogo, from the Nivel Central del Ministerio de Salud, Dra. Joselyn Chacón Madrigal, Exministra del Ministerio de Salud, and Licda. Carolina Gallo Chaves, Viceministra del Ministerio de Salud, were informed about the pesticide molecule clorotalonil, and the prohibition of clorotalonil was requested, stating verbatim (folios 0287 al 289 = 0106 al 0108): “… According to UNDP estimates, Costa Rica has a high level of pesticide consumption, compounded by a weakening of agricultural extension and research services within the Ministerio de Agricultura y Ganadería, which gives rise to risks of contamination of surface water and groundwater that may jeopardize water sources intended for human consumption.
Such events have occurred in Limón and the Zona Norte, with extremely serious economic and social consequences, and these contamination incidents now also include the communities of Cipreses and Santa Rosa de Oreamuno. Clorotalonil is a molecule capable of producing metabolites once it enters the environment and has a high contamination potential; according to EFSA, even when this pesticide is used correctly, it will still be capable of contaminating water sources, and there is insufficient toxicological information regarding its metabolites to determine potential health risks.
This is demonstrated by the situations occurring in the aqueducts of Cipreses and Santa Rosa de Oreamuno, where, although chlorothalonil measurements have been conducted, the chemical has not been detected; however, measurements of its metabolites have found high concentrations of them, demonstrating the potential risk of contamination that chlorothalonil poses to water for human consumption. With regard to the technical capacity to measure pesticide residues (residuos de plaguicidas), the country is lagging behind, since there is no direct correlation among the registered molecules, their metabolites, and the analytical techniques available in State laboratories for measuring them in surface-water and groundwater bodies (cuerpos de agua superficial y subterránea). Therefore, this situation becomes hazardous because chlorothalonil metabolites cannot be systematically and routinely included in the drinking-water monitoring (vigilancia de agua potable) conducted in the country.
Furthermore, this creates a disadvantage for any remediation and mitigation intervention or plan (plan de saneamiento y mitigación), because measurements cannot be conducted to implement monitoring and compliance indicators. As a final conclusion, following an overall assessment of the risks associated with the use of chlorothalonil, the lack of information regarding toxicity, and the risks of contamination of surface water and groundwater, a recommendation is issued to prohibit the chlorothalonil molecule; such a prohibition would allow a remediation process to begin for the contaminated sources in Cipreses de Oreamuno and Santa Rosa de Oreamuno, with a view to the future restoration and reopening of the drinking-water sources, as well as to safeguarding—as DIGECA states in its report—the constitutionally protected interests (bienes constitucionales) of human health, biodiversity, and the environment, in addition to preventing future contamination.
In light of this request to prohibit the molecule, it is recommended that a coordination process be initiated with the Dirección de Productos de Interés Sanitario (DRPIS) and the senior officials of the Ministerio de Ambiente y Energía and the Ministerio de Agricultura y Ganadería, for the purpose of drafting a decree that will bring about a prohibition as quickly as possible…” [sic] In view of the foregoing, and as part of the interinstitutional work that has been carried out by the Ministerio de Salud and in response to the instructions received from the Despacho de la Viceministra de Salud, a technical team was formed with officials from the Ministerio de Salud, Instituto Costarricense de Acueductos y Alcantarillados, and the Ministerio de Ambiente y Energía to prepare a technical report, which has already been completed and focuses on the problems associated with the use of the pesticide (plaguicida) chlorothalonil and its metabolites in Costa Rica; it contains the recommendation that its use be prohibited in the country.
The possibility of replacing chlorothalonil with biopesticides or biological control agents (controladores biológicos) is mentioned. It also emphasizes the importance of considering environmental and human health in any action plan that may be established. That report has already been forwarded to the Despacho Viceministra through official letter (oficio) MS-DPRSA-USA782-2023 (folios 0442 al 0452 = folios 109 al 119). In view of all the foregoing, the Ministerio de Salud has acted to the extent of its capabilities in order to safeguard water sources and guarantee the fundamental rights to life and health, as well as the well-being of the population, which constitute legally protected interests of public concern (bienes jurídicos de interés público) that the State is obligated to protect by adopting measures to defend them against any threat or danger. Every person has the basic and inalienable human right to access drinking water, as an essential good for life.
Likewise, the right to a healthy and ecologically balanced environment must also be protected. Your authority is hereby informed of the actions taken by the Ministerio de Salud to date in addressing the matters reported by the petitioner (recurrente), with this agency continuing, to the extent of its capabilities, to fulfill its duties to guarantee drinking water fit for human consumption in the community of Dirección212, (…)”.
Regarding the March 2022 request, a response was received in October 2022 from the head of the Centro Nacional Especializado en Agricultura Orgánica, offering the course program to be taught during the first quarter of 2023. This program has been shared with producers in the Zona Norte de Cartago as an option for expanding their knowledge and providing them with tools to address contamination by agrochemicals (agroquímicos), without neglecting the productive focus of their economic activities. It should be noted that this information is shared for informational and motivational purposes; however, there is no possibility of making participation mandatory for producers. The “Remedial Management Plan (Plan de manejo remedial) to Be Implemented at the Water Sources of ASADA Cipreses de Oreamuno” also proposes carrying out the work in stages, with actions and the time required for progress (see Table 2), the indicators for which were improved in order to clarify and monitor compliance and progress.
It should be noted that this is a long-term plan (2 or 3 years from its implementation), because the period required before fungicides are no longer detected in the water is lengthy due to the nature of these contaminants and the processes required for the molecules to break down, and because, until agrochemicals are used properly, the decontamination process will not begin. The SFE has worked on preparing the draft proposal for the Executive Decree “General Regulations Establishing the Conditions for Ground Applications of Agrochemicals (Reglamento General para establecer las condiciones de aplicaciones terrestres de agroquímicos),” which is ready for approval by the senior officials of the institutions involved (Ministerio de Agricultura y Ganadería and Ministerio de Salud). These regulations are important because there are currently no national regulations governing ground applications that specify setback distances (distancias de retiro) and requirements based on site conditions, equipment, and the product to be applied.
This instrument will help reduce the risk of accidents arising from ground applications of agrochemicals and the resulting contamination of soil, water, surrounding areas, etc. (…) In a third stage, with a two-year timeframe, the actions proposed in Table 2 are intended to include sampling for agrochemical residues (residuos de agroquímicos) in vegetables from at least 80% of the agricultural producers located in groundwater recharge areas (zonas de recarga hídrica). This timeframe takes into account the ordinary budget available to the SFE for conducting agrochemical residue analyses, an amount that has tended to decrease each year and must cover producers throughout the Región Central Oriental (…)”.
Opinion drafted by Magistrado Araya García; and,
Whereas:
I.Admissibility of the amparo action (recurso de amparo) against a private-law entity (sujeto de derecho privado). The Ley de la Jurisdicción Constitucional, in its Article 57, specifies the circumstances under which amparo is admissible against the acts or omissions of private-law entities, and provides that this type of action is admissible when they act or are required to act in the exercise of public functions or powers, or when they are, in fact or in law, in a position of power against which ordinary judicial remedies are clearly inadequate or untimely for guaranteeing the fundamental rights or freedoms referred to in Article 2°, subsection a), of that same Law. In this particular case, those requirements are met because it is alleged that the ASADA de Santa Rosa de Oreamuno is in a position of power with respect to the appellant, by virtue of the complaint regarding contamination of the water supplied by the respondent, which allegedly has not been resolved.
II.Subject matter of the action. The appellant considers that his fundamental rights have been violated, since he is a resident of Cipreses de Cartago, a community that receives drinking-water service through the ASADA de Santa Rosa de Oreamuno de Cartago. He complains that, since 2021, that association’s aqueduct has experienced contamination problems involving a substance known as “chlorothalonil,” as a result of which the Ministerio de Salud issued health orders (órdenes sanitarias) and orders closing five water springs (nacientes), specifically the following springs: Piedra, Nombre730 , Birris, Agua Fría and Manuel Granados. He further states that the contamination problems cited above were confirmed through a study conducted jointly by IRET-UNA and the Laboratorio Nacional de Agua del Instituto Costarricense de Acueductos y Alcantarillados. Nevertheless, he complains that the contamination problems persist.
A.- Regarding the ASADA de Santa Rosa de Oreamuno:
B.- Regarding the Área Rectora de Salud de Oreamuno and the Ministerio de Salud:
In the specific case of the metabolites 1,3-dicarbamoyl-2,4,5,6 tetrachlorobenzene and 4-hydroxychlorothalonil, little documentation is available, particularly regarding their effects on human health, although somewhat more information exists concerning the environmental and ecotoxic risks of 4-hydroxychlorothalonil. Internationally, the European Union decided in 2019 to prohibit the use of the pesticide chlorothalonil because a critical problem was identified in relation to groundwater contamination by the pesticide’s metabolites. The European Authority was unable to rule out a potential genotoxicity concern regarding the residues to which consumers would be exposed and identified a high risk to amphibians and fish in all assessed uses. Furthermore, chlorothalonil itself is classified as a carcinogen. On the other hand, the United States Environmental Protection Agency (EPA) has determined that chlorothalonil products do not pose risks to humans or the environment provided that authorized uses and the instructions on the product label are followed.
However, it has stated that studies are lacking to determine the risks posed by its metabolites. In conclusion, from a human-health perspective, there is a lack of scientific studies characterizing and identifying health risks associated with the consumption, ingestion or any other form of contact with the metabolite 1,3-dicarbamoyl-2,4,5,6 tetrachlorobenzene; however, studies do characterize chlorothalonil as highly toxic to aquatic life and moderately toxic to birds and earthworms. Accordingly, any indication of contamination involving this pesticide or metabolite must be treated with extreme caution, and the necessary measures must be taken to prevent its ingestion or contact, in view of the limited scientific evidence concerning human health and with reliance on the studies confirming its ecotoxicity, as well as the risk to environmental health (…)” (see report submitted under oath and evidence submitted to the judicial case file).
The use of water from these sources may be considered for the operation of toilets and other cleaning and disinfection activities within the home. • A Health Order shall be issued to the Instituto Costarricense de Acueductos y Alcantarillados requiring it to provide water to the community immediately through tanker trucks or any other mechanism that ensures the availability of safe water for human consumption by the population of Santa Rosa. • A Health Order shall be issued to the ASADA Santa Rosa and the Instituto Costarricense de Acueductos y Alcantarillados requiring them to communicate correctly and assertively to the community, through as many channels as possible, the situation affecting the ASADA Santa Rosa concerning metabolites of the pesticide chlorothalonil and the application of the precautionary principle, in order to prevent health problems among the population; they shall also clarify that water for human consumption, food preparation and hygiene will come exclusively from tanker trucks, while water from the aqueduct may be considered for the operation of toilets and other cleaning and disinfection activities within the home. • Through a Health Order, the Instituto Costarricense de Acueductos y Alcantarillados shall be required, within a reasonable statutory period, to submit an Action Plan containing short-, medium- and long-term measures and indicating the steps to be taken to resolve the contamination affecting the ASADA de Santa Rosa, whether through interconnections with other ASADAS, the search for new sources, the implementation of treatment systems or other measures, as determined by its technical governing authority for drinking water.
It should be noted that, in system 1, Naciente Nombre731 and, in system 2, Nombre732 remain authorized for use and may therefore constitute an option for providing safe water to the population of Santa Rosa, provided that these systems disconnect the other contaminated springs (…)” (see report submitted under oath and evidence submitted to the case file).

This is demonstrated by the situations occurring in the aqueducts of Cipreses and Santa Rosa de Oreamuno, where, although Clorotalonil measurements have been taken, the chemical has not been detected; however, measurements of its metabolites have revealed high concentrations, demonstrating the potential contamination risk posed by Clorotalonil in water intended for human consumption. With respect to the technical capacity to measure pesticide residues, the country is lagging behind because no direct relationship exists among registered molecules, their metabolites, and the analytical techniques available to State laboratories for measuring them in surface-water and groundwater bodies.
Therefore, this situation becomes hazardous because the metabolites of Clorotalonil cannot be included systematically and according to schedule in the drinking-water monitoring activities conducted in the country. In addition, this places any remediation and mitigation intervention or plan at a disadvantage because measurements cannot be taken to implement monitoring and compliance indicators. As a final conclusion, following a general assessment of the risks associated with the use of Clorotalonil, the lack of information regarding toxicity, and the risks of surface-water and groundwater contamination, a recommendation is issued to prohibit the Clorotalonil molecule. Such a prohibition would allow a remediation process to begin for the contaminated sources in Cipreses de Oreamuno and Santa Rosa de Oreamuno, with a view toward the future restoration and reopening of the drinking-water sources, while also safeguarding, as DIGECA states in its report, the constitutional interests of human health, biodiversity, and the environment, as well as preventing future contamination.
In light of this request to prohibit the molecule, it is recommended that a coordination process be initiated with the Dirección de Productos de Interés Sanitario (DRPIS) and the senior officials of the Ministerio de Ambiente y Energía and the Ministerio de Agricultura y Ganadería in order to draft a decree that will bring about a prohibition as soon as possible (…)” (see sworn report and evidence submitted to the case file).
Accordingly, it is advisable to apply the precautionary principle (principio precautorio) and take action at the local Área Rectora level so that the water from Nombre732 is not consumed by the population until there are at least 3 negative samples. This is necessary to ensure that the water is safe for human consumption and does not pose a public-health risk. It is important to note that the Ministerio de Salud, as the governing authority (ente rector) for public health, must safeguard the health of the population, beginning with prevention. Therefore, it is recommended that coordination take place with the ASADA and AYA to implement water-quality prevention and control measures, as has previously been done in a similar manner with the other springs (nacientes) (…)” (see report submitted under oath and evidence entered into the case file).
The use of water from this source for flushing toilets and other household cleaning and disinfection activities may be considered. The foregoing is in compliance with the instructions provided by Dr. Albin Badilla Mora in an email titled Laboratory Report on the Analysis of Samples from ASADA Santa Rosa de Oreamuno, Nov. 2022, dated today, 23 de marzo del 2023, and received by this Área Rectora de Salud at 09:04 (…)” (see report submitted under oath and evidence entered into the case file).
In the absence of information characterizing and identifying health risks associated with the consumption, ingestion, or any other type of contact with the metabolites, water from this source may not be used for human consumption, food preparation, or personal-hygiene activities, pursuant to the precautionary principle. The use of water from this source for flushing toilets and other household cleaning and disinfection activities may be considered. The foregoing is in compliance with the instructions provided by Dr. Albin Badilla Mora in an email titled Laboratory Report on the Analysis of Samples from ASADA Santa Rosa de Oreamuno, Nov. 2022, dated today, 23 de marzo del 2023, and received by this Área Rectora de Salud at 09:04 (…)” (see report submitted under oath and evidence entered into the case file).
Failure to address and comply with these matters, as defined by law and case law, may result in the violation of the right to a healthy environment and to public health. In this regard, the Costa Rican State has the power and duty to ensure the effective and timely protection of these fundamental rights, thereby improving the population’s standard of living. 2. Chlorothalonil is used primarily as a fungicide on a wide range of crops, including vegetables and fruits. More than 20 metabolites of this fungicide have been identified, including 4-hydroxychlorothalonil and 3-carbamyl-2,4,5-trichlorobenzoic acid, which are moderately mobile and persistent. 3. Chlorothalonil has been banned in the European Union because of its carcinogenic potential and its ability to contaminate groundwater with metabolites resulting from its degradation. Although chlorothalonil has been banned, its metabolites remain a persistent problem in the environment and drinking-water supply.
In Switzerland, chlorothalonil by-products have been detected in groundwater and drinking water in several cantons, at levels exceeding the statutory standards established for drinking water. Chlorothalonil metabolites have also been found in surface waters such as the Rhine River and Lake Zurich. 4. Chlorothalonil is a molecule that, although it has low leaching potential, can be highly toxic to fish and aquatic invertebrates when applied during rainy periods. In addition, its degradation products, such as 4-hydroxychlorothalonil, may be toxic to mammals and birds, including reproductive and carcinogenic effects. Residues of chlorothalonil metabolites have also been found in foods such as blueberries up to 76 days after application. 5. In light of the evidence presented, it may be concluded that chlorothalonil poses significant risks to human health and the environment. The United States Environmental Protection Agency has classified chlorothalonil as a possible human carcinogen and a possible reproductive and developmental toxicant, and exposure to this compound may cause irritation of the skin, eyes, and respiratory tract, as well as nausea, headache, and dizziness.
The European Food Safety Authority, for its part, has identified critical concerns; moreover, the assessment of consumer risk resulting from dietary exposure could not be completed because data were missing from the record, suggesting that the use of this fungicide may pose an unknown risk to public health. 6. In conclusion, the assessment conducted by EFSA indicates that chronic dietary exposure to chlorothalonil may pose a risk to human health, especially for the most vulnerable population groups. In addition, highly contaminating chlorothalonil metabolites have been identified in water sources intended for human consumption, demonstrating the potential risk of contamination. Although little is yet known about the effects these compounds may have on human health, the precautionary principle must be applied in decision-making and preventive measures must be taken to minimize exposure to these compounds.
The ban on the use of chlorothalonil in the European Union is an example of how the precautionary principle is being applied to protect human health and the environment. 7. In the province of Cartago, Costa Rica, there are eight springs (nacientes) intended for human consumption that are being contaminated because agricultural and livestock activities are encroaching upon protection zones (zonas de protección) and aquifer recharge zones (zonas de recarga de acuíferos). Chlorothalonil metabolites have been detected in the Cipreses and Santa Rosa water-supply systems in the canton of Oreamuno. It is therefore necessary to take measures to prevent contamination of additional water sources and to protect the population’s health. 8. It is concluded that chlorothalonil raises environmental concerns, primarily because of its acute and chronic toxicity to aquatic organisms and the danger posed by its metabolites due to their potential to contaminate both surface water and groundwater.
Furthermore, it is a pesticide commonly used on vegetables, and it is concerning that the country lacks the technical capacity to properly oversee and monitor its metabolites in soil and water, as is also the case with other pesticides currently in widespread use. 9. In response to the problem posed by the use of the pesticide chlorothalonil in water sources, MAG proposes options such as replacing it with other pesticides having the same mechanism of action, promoting localized application systems, and respecting the surrounding protection zone. 10. The evidence shows that MAG’s oversight, regulation, and control of the use of the pesticide chlorothalonil in Costa Rica have weakened, creating an environmental and public-health problem in the area where it is applied. 11. Replacing chlorothalonil with biopesticides or biological control agents is an alternative that MAG does not extensively address in its remedial plan.
Nevertheless, this alternative must be analyzed on a case-by-case basis by identifying control agents for each pest and crop and conducting efficacy tests. 12. It is necessary to identify the crops in the area and the pests being treated and to confirm the relevant registrations with SFE in order to understand the problem caused by chlorothalonil. Work plans must be established to determine whether Good Agricultural Practices (Buenas Prácticas Agrícolas, BPA) are being applied correctly and whether replacement with other pesticides and/or biopesticides is possible. It should be emphasized that replacing chlorothalonil does not guarantee the complete elimination of pesticide use, because certain alternative products are being reevaluated for their effects on health and the environment. Recommendations 1. It is recommended that the Servicio Fitosanitario del Estado increase its oversight and control and promote the replacement of chlorothalonil with safer pesticides and the adoption of Good Agricultural Practices.
This will ensure the protection of the environment and the health of the population in this and other regions of the country where this pesticide is used. 2. It is recommended that the Laboratorio Nacional de Aguas be strengthened so that it has the resources necessary to quantify chlorothalonil metabolites and so that a nationwide program for monitoring and controlling chlorothalonil and its metabolites in water intended for human consumption can be implemented. 3. Therefore, in addition to the recommendations issued in official letter DIGECA-563-2022, it is recommended that SFE compile an inventory of the pesticides most widely used in the country and prioritize the analysis of residues in water sources, soil, and plants according to updated import volumes, including the metabolites of these pesticides currently in widespread use. 4. The Costa Rican State is responsible for regulating the use of chemical substances in agriculture so as to ensure their proper management and use without posing unacceptable risks to human health and the environment.
Although certain substances may be used in accordance with usage recommendations, it is important to consider the potential risks posed by the metabolites and residues generated and to apply the precautionary principle in order to make informed decisions and protect the health and well-being of the population and the ecosystem. 5. The institutions responsible for pesticide regulation and control must take urgent measures to prevent and mitigate the adverse impacts associated with the use of this pesticide. This entails implementing effective oversight strategies, promoting sustainable agricultural practices, and gradually eliminating chlorothalonil from the country’s agricultural industry. Ultimately, the protection of human health and the environment must be the primary objective of any pesticide-management strategy. 6. To protect bodies of water and reduce the risk of contamination from pesticide use, it is recommended that localized application systems be promoted and that the surrounding protection zone be respected, as established in article 33 of Ley N° 7575, Ley Forestal, for the protection areas (áreas de protección) of bodies of water defined in that law.
These measures promote the protection of bodies of water and the health of the population that depends on them. 7. Based on the hazard warnings concerning chlorothalonil and the concern that products registered on the basis of this Technical-Grade Active Ingredient (Ingrediente Activo de Grado Técnico, IAGT) do not have DIGECA’s environmental endorsement, it is considered essential, in the interest of safeguarding the environment, to cancel the registrations currently in force for products based on this pesticide. This is in accordance with the provisions of sections ...04 and ...05 of Placa50 and 16.2 of Placa51 and articles 29 and 30 of Ley 7664 Ley de Protección Fitosanitaria concerning suspensions and cancellations of registration. 8. Consistent with the recommendations set forth above and the risks analyzed, it is recommended that the use of chlorothalonil be prohibited in Costa Rica, in line with the measures adopted by the European Union.
Safety measures and agricultural alternatives must be implemented to minimize exposure among workers and consumers, while also ensuring the protection of water sources, the environment, and the population’s health (…)” (see evidence numbered with folios 00159 through 00175 and 00253 through 00285, submitted by the Ministerio de Salud in its report dated April 26, 2023, and resubmitted by the petitioner on May 31, 2023).
C.- Regarding ICAA:
Prohibition of chlorothalonil (responsible parties: Ministerio de Agricultura y Ganadería; Concejo de Gobierno; and Asamblea Legislativa); 6. Changes in agricultural practices (responsible party: Ministerio de Agricultura y Ganadería); 7. Characterization of the effects on human health caused by the presence of chlorothalonil metabolites (responsible parties: Ministerio de Salud; Ministerio de Agricultura y Ganadería; Laboratorio Nacional de Aguas del AyA); 8. Changes in land uses (usos de suelo) (responsible parties: Ministerio de Agricultura y Ganadería and local governments); 9. Non-use of water sources for human consumption (responsible parties: Nombre733 Ministerio de Salud and Dirección de la UEN Asadas); 10. Distribution of water by tanker truck (responsible parties: Asadas; Dirección UEN Asadas); 11. Remediation of water sources (responsible parties: MINAE; local governments; Ministerio de Salud; Laboratorio Nacional de Aguas); 12. Reopening and protection of water sources (Ministerio de Salud and Laboratorio Nacional de Aguas del AyA)” (see report submitted under oath).
D.- Regarding MINAE (SINAC) and MAG:
That the SFE, as the competent authority for managing the use of agrochemicals (agroquímicos), develop an action plan to prohibit chlorothalonil, with the aim of remediating the problem of water contamination by this fungicide, following the steps taken by the European Union, where its registration has not been renewed because the proposed uses have demonstrated risks to human health and the environment. That, through official letter DIGECA-134-2023, Licda. Shirley Soto Montero, Director of the Dirección de Gestión de Calidad Ambiental, responded to the Ministerio de Salud regarding the request for an interinstitutional team to provide input concerning contamination by CHLOROTHALONIL in water sources, for the purpose of preparing a report, requesting that the SFE, as the competent authority for managing the use of agrochemicals, develop an action plan to ensure the safe use of chlorothalonil in the affected area, in pursuit of remediation of the problem of water contamination by this fungicide, including specific actions, the corresponding indicators demonstrating a reduction in harm to the population, and the resources necessary for its implementation.
Otherwise, it should proceed with the process of prohibiting the use of products containing chlorothalonil, following the steps taken by the European Union, where its registration has not been renewed because the proposed uses have demonstrated health risks (…)” (see report submitted under oath and evidence entered into the digital case file).
Some of the activities that have been conducted and scheduled to address this situation are described below: In response to Sanitary Order MS-DRRSCE-DARSO-OS-0098-2022, the ‘Remedial management plan for implementation at water sources of ASADA Cipreses de Oreamuno’ was prepared. Its 26 pages include important considerations stating that it is of utmost importance to promote molecule rotation to prevent their accumulation in soils, waters, and crops and to prevent them from losing effectiveness in controlling pests and diseases, so that decontamination will also be sustainable over time. Nevertheless, being mindful of the processes currently conducted in the country for registering new molecules, expanding authorized uses, and obtaining equivalencies, it is proposed that the heads of MAG, Ministerio de Salud, and MINAE, primarily, prepare a decree pursuant to Article 29 of Ley 7664 to regulate the sale and/or use of chlorothalonil nationwide.
This decree is suggested to establish restricted sale, authorized only by professional prescription, so that the product may be marketed solely by companies with agricultural technical supervisors (regentes agrícolas), for which the corresponding responsibility of those supervisors and oversight by the Colegio de Ingenieros Agrónomos de Costa Rica are required. This action would be a measure adopted pursuant to the precautionary principle (principio precautorio), similar to that applied by the Ministerio de Salud when issuing the sanitary order to close the ASADAS, and pursuant to the pro natura principle (principio pro natura), but supported by the technical evidence of findings in the water sources of the metabolite 1,3-dicarbamoil-2,4,5,6tetrachlorobenzene (derived from the fungicide chlorothalonil). The SFE is the body with legal authority to prohibit producers from using specific agrochemicals or molecules if they have the corresponding registrations for use in the country and for the crop or activity being carried out; likewise, there is no legal authority to compel producers to follow the recommendations made by technical personnel in each case or to participate in any training sessions that may be proposed or scheduled.
Therefore, the measures cannot be based solely on certain criteria and restrictive solutions; accordingly, this plan proposes multiple measures to find solutions that comprehensively and effectively reduce the use of the identified molecules while also providing due process (debido proceso) for identifying and approving alternative and substitute measures, thereby ensuring a balance among all socioeconomic, health, and ecological factors. The Unidad Regional Central Oriental of the SFE does not have the authority to prohibit or restrict the use or marketing of specific pesticides at the regional level; instead, the heads of our institutions, together with the heads of the Ministerio de Salud and the Ministerio de Ambiente y Energía and, on occasion, the heads of the Ministerio Trabajo y Seguridad Social, must work jointly to prepare the corresponding Executive Decree (Decreto Ejecutivo), which, once approved, signed, and published, may direct us to impose one of the following types of controls: Total prohibition, Total prohibition except for specific formulations, Prohibition of specific product sizes, Prohibition of specific uses, Total restriction requiring professional prescription, Restriction of specific formulations, Restriction of specific uses, Other restrictions (No over-the-counter sale, type of application, etc.).
It should be recalled that this problem was initially addressed under a specific name, namely: ‘Remedial management plan for implementation at water sources of ASADA Cipreses de Oreamuno,’ but management was extended to all neighboring Nombre733. The plan identifies the stakeholders who must be involved in its implementation, the need for updated hydrogeological studies that consider important details concerning the movement and behavior of potential contaminants (primarily agrochemicals) in water, the regulatory program, the program to phase out the use of chlorothalonil, the need for new molecules and new technologies, and the need for a training plan to provide producers with tools. The reduction in the frequency of chlorothalonil use described in the ‘Remedial management plan for implementation at water sources of ASADA Cipreses de Oreamuno’ identifies the registered commercial products containing chlorothalonil among their ingredients (at least 53 commercial products from 29 different registrant companies were found), as well as the list of crops (garlic, celery, squash, broccoli, coffee, onion, sweet pepper, citrus fruits, cauliflower, beans, lettuce, melon, beets, cabbage, tomato, carrots, potatoes, cucumber, zucchini, bananas, plantains, watermelon, leeks, green beans, rice, pumpkin, papaya, and others) approved on labels in Costa Rica for these commercial products (…)” (see report submitted under oath and evidence entered into the digital case file).
IV.Relevant precedent. As a preliminary matter, it is necessary to recall the Chamber’s ruling in judgment No. 2022-026065 at 9:45 on 4 de noviembre de 2022, in which contamination of the water at the Nombre424 and Nombre423 springs of ASADA de Cipreses de Oreamuno de Cartago was reported. Accordingly, in the cited judgment, this Court ruled as follows:
“II.-PURPOSE OF THE PETITION. The petitioners state that the Nombre424 and Nombre423 springs (nacientes), belonging to the ASADA de Cipreses de Oreamuno de Cartago, tested positive for pesticides, as acknowledged by the Instituto Costarricense de Acueductos y Alcantarillados, based on a study by the Instituto Regional de Estudios en Sustancias Tóxicas (IRET) of the Universidad Nacional. They add that IRET report UNA-LAREP-OFIC-060-2021-S20-13-05-2021 of 17 de diciembre de 2021 mentions the presence of degradation products of the pesticide chlorothalonil, as well as traces of 9 different pesticides in the water from the aforementioned springs. They assert that the Ministerio de Salud is aware of the situation, as documented in technical report MS-DRRSCEDARSO-IT-00312-2021. They point out that the positive contamination results were submitted beginning in 2021 to the Ministerio de Salud and the ASADA de Cipreses de Oreamuno de Cartago, but the appropriate measures were not taken to protect public health or the environment.
They specify that, beginning on 1° de abril de 2022, written complaints were filed with the Área Rectora de Salud de Oreamuno of the Ministerio de Salud and the Gerencia General del Instituto Costarricense de Acueductos y Alcantarillados, requesting that water free of toxic agricultural contaminants be supplied in tanker trucks pursuant to the precautionary principle (principio precautorio); that testing be conducted periodically to maintain continuous monitoring of chlorothalonil degradation products; that the pesticide-monitoring results be provided to them and made public; and that the protection areas surrounding the community’s water intakes be safeguarded. They state that, in response to the complaints, the Laboratorio Nacional de Aguas of ICAA conducted a water analysis for certain pesticides but failed to address the presence of specific chlorothalonil byproducts and neither analyzed nor reported the compounds “3- dicarbomoil-2,4,5, tetraclorobenceno y el 4-hidroxiclorotalonil”; despite this, it publicly asserted that the water was potable. They emphasize that IRET of the Universidad Nacional, the Ministerio de Salud, and the Instituto Costarricense de Acueductos y Alcantarillados itself have acknowledged the water contamination. (…)
In the case at bar (sub lite), the petitioners state that the Nombre424 and Nombre423 springs, belonging to the ASADA de Cipreses de Oreamuno de Cartago, tested positive for pesticides, as acknowledged by the Instituto Costarricense de Acueductos y Alcantarillados, based on a study by the Instituto Regional de Estudios en Sustancias Tóxicas (IRET) of the Universidad Nacional. They add that IRET report UNA-LAREP-OFIC060-2021-S20-13-05-2021 of 17 de diciembre de 2021 mentions the presence of degradation products of the pesticide chlorothalonil, as well as traces of 9 different pesticides in the water from the aforementioned springs. They assert that the Ministerio de Salud is aware of the situation, as documented in technical report MS-DRRSCE-DARSO-IT-00312-2021. They point out that the positive contamination results were submitted beginning in 2021 to the Ministerio de Salud and the ASADA de Cipreses de Oreamuno de Cartago, but the appropriate measures were not taken to protect public health or the environment.

They state that, in response to the complaints, the Laboratorio Nacional de Aguas of ICAA conducted a water analysis for certain pesticides but failed to address the presence of specific chlorothalonil byproducts and neither analyzed nor reported the compounds “3-dicarbomoil-2,4,5, tetraclorobenceno y el 4- hidroxiclorotalonil”; despite this, it publicly asserted that the water was potable. They emphasize that IRET of the Universidad Nacional, the Ministerio de Salud, and the Instituto Costarricense de Acueductos y Alcantarillados itself have acknowledged the water contamination. (…)
In this regard, it has been established that, at least since the previous year, the respondent authorities have undertaken efforts to confirm or rule out the presence of pesticides in the Nombre736 and Nombre423 springs (systems administered by the ASADA de Cipreses de Oreamuno). To that end, various studies concerning the pesticide chlorothalonil have been conducted due to suspected residues in the aforementioned springs. Thus, in report no. MS-DPRSA-USA-679- 2022 of 28 de abril de 2022, the Unidad de Salud Ambiental del Ministerio de Salud stated: “RESULTS. As shown in Table 1, the pesticide chlorothalonil was not detected in the samples collected at ASADA Cipreses, either for the Nombre736 System or for the Nombre423 System (…)
The presence of pesticides was not detected in these specific analyses conducted at the springs of both systems, nor was chlorothalonil detected.” However, beginning in December of the previous year, the Laboratorio de Análisis de Residuos de Plaguicidas de la UNA conducted a study that detected chlorothalonil degradation products, specifically: “1,3 dicarbamoil-2, 4,5,6- tetraclorobenceno y el 4-hidroxiclorotalonil.” Subsequently, during the processing of this constitutional proceeding, specifically on 26 de septiembre anterior, another sampling was performed at the springs in question, and the resulting report stated: “the samples collected from the two springs in the community of Cipreses (Nombre736 and Nombre423 ) were injected, as were five standards of 250 μg/L 500 μg/L, 750 μg/L, 1000 μg/L and 2000 μg/L. The results obtained are detailed below: For the Nombre736 spring, an approximate concentration of 1,3- dicarbamoyl-2,4,5,6-tetraclorobenceno of 19,36 μg/L was obtained in the collected sample, whereas for the Nombre423 spring, the approximate concentration in the collected sample was 1,73 μg/L.
The standard provided by Mr. Clemens Ruepert was used for the determinations in both sampling rounds. It should be noted that the standard used is not certified with traceability under the terms of accreditation of international standard INTE-ISO/IEC 17025:2017 (nor has a standard meeting this requirement been found). Additionally, the method used for this determination is not accredited and, at present, the corresponding validation is still unavailable, resulting in limited certainty regarding the compound’s exact concentration. Nevertheless, the concentrations found exceed the maximum admissible value established by regulation DE 38924-S.” Accordingly, although the respondents state that the studies and results are not accredited under the terms of section 10 of the Reglamento para la Calidad de Agua Potable, it remains true that the reported concentration of metabolites (19,36 μg/L and 1,73 μg/L) clearly indicates a contamination problem, since the values substantially exceed the maximum permitted by ordinary regulations (which is 0.1 μg/L).
Indeed, health order (orden sanitaria) no. MS-DRRSCE-DARSO-OS-0087-2022 stipulated that those water sources could not be used for consumption, food preparation, or personal hygiene activities. Although the respondents had known of the presence of metabolites in the aforementioned springs since the first study conducted at the end of the previous year, concrete measures were not taken until the second sampling (conducted while this petition was being processed), and those measures do not provide a definitive solution to the situation at issue. Thus, although the health orders issued on 20 de octubre del año en curso ordered the immediate closure of the Nombre736 and Nombre423 sources belonging to the ASADA de Cipreses, notification of the situation to the community of Cipreses de Oreamuno, the supply of water to that community through tanker trucks, and the preparation of a corrective plan, it remains true that such actions are provisional measures, whereas the situation at issue in the matter under adjudication (sub iudice) warrants a comprehensive and definitive solution within a reasonable period. (…)
Por tanto: The petition is granted. Eric Alonso Bogantes Cabezas and María José Lafuente González, respectively, general manager of the Instituto Costarricense de Acueductos y Alcantarillados and acting director of the Área Rectora de Salud de Oreamuno, or whoever may respectively hold those positions, are ordered to issue the pertinent directives and undertake all actions within the scope of their respective authority so that, within a maximum period of THREE MONTHS from notification of this judgment, the pertinent coordination and actions are carried out under a joint plan to: 1) comprehensively and definitively resolve the chlorothalonil-metabolite contamination affecting the Nombre736 and Nombre423 springs of the ASADA de Cipreses de Oreamuno; and 2) investigate whether the contamination affecting the aforementioned springs has harmed other communities in the area. In the interim, the aforementioned authorities must guarantee the supply of potable water to the affected communities through tanker trucks or another alternative…”.
V.Environmental protection and the principle of administrative coordination (principio de coordinación administrativa). In Judgment No. 2012-8892 at 16:03 hours on 27 de junio de 2012, this Chamber held as follows:
“(…) VI. The principle of inter-administrative coordination (principio de coordinación interadministrativa). One of the governing principles of administrative organization is the coordination that must exist among all public entities and bodies when exercising their authority and providing the services assigned to them by the legal system. Coordination, insofar as it ensures administrative efficiency and effectiveness, is a virtual or implicit constitutional principle that permeates the entire body of administrative law and binds all public entities. It may be inter-organic—among the various bodies comprising a public entity that are not subject to a hierarchical relationship—or intersubjective, that is, among public entities, each possessing legal personality, its own budget, autonomy, and specific authority. The administrative autonomy or other degree of autonomy held by public entities obliges them to coordinate their actions, since, by virtue of their inter-organic nature, they cannot be reciprocally subject to hierarchical relationships.
The purpose of administrative coordination is to prevent duplication and omissions in the performance of each public entity’s administrative functions—that is, to ensure that those functions are performed rationally and systematically—and it is achieved by establishing fluid and permanent levels or channels of information among public entities, all of which may be accomplished through meetings, reports, or the creation of formal coordinating bodies.
VII.Inter-institutional coordination in environmental matters (coordinación interinstitucional en materia ambiental). Specifically with regard to environmental protection, judgment number 2008-004790 emphasized the duty of coordination among the institutions involved in the matter and the impossibility of disregarding warnings concerning the risk of contamination issued by an institution legally empowered to protect water resources:
“III.- Coordination among public agencies must guarantee environmental protection. On various occasions, constitutional case law (jurisprudencia constitucional) has indicated that protecting the environment is a task that falls equally to everyone; that is, the State—as a whole—is obligated to take the measures necessary to protect the environment in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed. In this undertaking, the term public institution must be understood to encompass both the Central Administration—Ministries such as the Ministerio del Ambiente y Energía and the Ministerio de Salud, which, by reason of their subject matter, have broad participation and responsibility with respect to environmental conservation and preservation and which, in most cases, act through their specialized agencies in the field, such as the Dirección General de Vida Silvestre, the Dirección Forestal, and the Secretaría Técnica Nacional Ambiental (SETENA)—as well as decentralized institutions, such as the Instituto Nacional de Vivienda y Urbanismo, the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, the Instituto Costarricense de Turismo, and the Instituto Costarricense de Acueductos y Alcantarillados.
Municipalities, of course, bear significant responsibility in this undertaking within their territorial jurisdictions. It might therefore be thought that this multiple responsibility would cause chaos in administrative management, but this is not the case. To prevent the simultaneous coexistence of spheres of authority of differing origin and nature, the duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordinating relationships among the various agencies of the Executive Branch and decentralized institutions, and between those entities and the municipalities, so that they may carry out the functions entrusted to them. This Chamber previously—and quite clearly—addressed the principle of coordination between public agencies and municipalities in pursuing common objectives—which, obviously, must also be extended to the relationship between Central Administration institutions and decentralized institutions in carrying out this important function—and therefore refers to what was stated on that occasion (judgment number 5445-99, de las catorce horas treinta minutos del catorce de julio de mil novecientos noventa y nueve):
“Thus, coordination is the ordering of the relationships among these various independent activities, taking account of their concurrence with respect to the same object or entity in order to make it useful to an overall public plan, without eliminating the reciprocal independence of the participating entities. Since no hierarchical relationship exists among decentralized institutions, or between the State itself and the municipalities, specific conduct cannot be imposed upon them. This gives rise to the indispensable interinstitutional ‘agreement,’ in the strict sense, whereby autonomous and independent centers of action agree on that preventive and comprehensive framework, in which each performs a role with a view to a mission entrusted to the others. Accordingly, relations between municipalities and other public entities may be conducted only on an equal footing, resulting in agreed forms of coordination and excluding any compulsory arrangement detrimental to their autonomy that would subject corporate entities to a coordination framework without or against their will; this nevertheless permits the necessary subordination of those entities to the State and in its interest (through the State’s ‘administrative oversight’ (tutela administrativa), and specifically through its function of reviewing legality, for which it has general supervisory powers over the entire sector).” Furthermore, failures to fulfill the duty to protect the environment and to comply with environmental regulations are constitutionally significant because the Administration’s inaction in this area may cause harm to the environment and natural resources, sometimes with consequences similar to or greater than those arising from actions of the Administration.
Examples include the authorization of zoning plans (planes reguladores) or construction without approval of the environmental impact study (estudio de impacto ambiental) by the Secretaría Técnica Nacional Ambiental; the failure of the Dirección General de Vida Silvestre of the Ministerio del Ambiente y Energía to control and oversee implementation of management plans (planes de manejo) for protected areas; allowing companies to operate without health permits regarding the treatment of sewage or wastewater (Acueductos y Alcantarillados and Ministerio de Salud); or failing to verify noise-level controls in bars, karaoke venues, and nightclubs (municipalities and Ministerio de Salud), among others (see, in this regard, judgment number 2006-005159 de las trece horas cuatro minutos del siete de abril del dos mil seis).” In other words, what matters is the technical cooperation that the various entities can provide one another, the technical input they can contribute, and respect for each entity’s jurisdiction, in order to guarantee beyond doubt that the projects being evaluated will not have an adverse impact, and thereby ensure the sustainable management of water resources and the full right to a healthy and ecologically balanced environment, as enshrined in the constitutional provision.
Thus, the precautionary principle (principio precautorio)—which seeks to prevent or suspend any activity that could adversely affect such management—requires the Administration, first, to notify the affected and interested parties and the institutions that may be involved. This allows them to submit the corresponding arguments and technical opinions and ensures the effective participation of the bodies with jurisdiction over the matter, with a view to protecting and preserving the environment and water resources. Second, it requires that due consideration be given to warnings issued by an institution legally empowered to protect water resources regarding the danger of contamination.”
VI.Concerning the right to health and to enjoy a healthy and ecologically balanced environment. Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized (Articles 21, 50, 73 and 89 of the Constitution), as well as recognized under international law. In this regard, this Constitutional Court stated the following in Voto No. 3705-93 de las 15:00 horas del 30 de julio de 1993:
“(...) Environmental quality is one measure of that quality of life; other equally important measures are health, food, work, housing, education, etc. More important, however, is to understand that although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for present and future generations. This is not particularly novel, because it is merely the application in this field of the principle of ‘injury’ (lesión), already firmly established in general law, under which the legitimate exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself (...)”.
The State likewise has an obligation to protect the environment, which is expressly established in the second paragraph of Article 50 of the Constitución Política and provides, in relevant part:
“(...) Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that violate that right and to seek compensation for the harm caused (...)”.
In relation to the foregoing, this Chamber held as follows in Sentencia No. 180-98 de las 16:24 horas del 13 de enero de 1998:
“(...) the State not only has the unavoidable responsibility to ensure that the health of each person comprising the national community is not harmed by third parties in relation to these rights, but must also assume responsibility for creating social conditions conducive to each person’s enjoyment of health, such right being understood as a state of physical, psychological (or mental), and social well-being (…)”.
Furthermore, subconstitutional legislation (normativa infraconstitucional) develops this right and, in this regard, the Ley General de Salud authorizes the Ministerio de Salud to adopt the corresponding health measures and impose penalties in order to protect the environment and people’s right to health. It should likewise be noted that this Court, as guarantor of fundamental rights, serves as a supervisory body for compliance with the obligations arising from Articles 21 and 50 of the Constitution, which require the State not only to recognize the rights identified above, but also to employ materially and legally legitimate means to guarantee them.
VII.On the right of access to drinking water. In repeated decisions, this Chamber has recognized a fundamental right to drinking water. It ruled on this right in resolution No. 2006-005606, de las 15:21 horas del 26 de abril de 2006, as follows:
«VII.-Access to drinking water as a human right. In addition to the foregoing—and perhaps the most relevant aspect of this issue—is the nature and function of water for human life. There is no need to provide a detailed explanation here of the evident and well-known fact that without water there can be neither life nor quality of life and that, therefore, with or without a nationalization law, by its very nature this issue is not and cannot be a territorial or local matter. This Chamber itself has stated in its constitutional case law that access to drinking water is a fundamental human right, insofar as it forms part of the substance of the rights to health and life. (SALA CONSTITUCIONAL, judgments numbers 534-96, 2728-91, 3891-93, 1108-96, 2002-06157 2002-10776; 2004-1923). This same line has been maintained in judgments 2003-04654 and 2004-07779, which state, in relevant part:
“V.- The Chamber recognizes, as part of Constitutional Law, a fundamental right to drinking water, derived from the fundamental rights to health, life, the environment, food, and adequate housing, among others, as has also been recognized in international human rights instruments applicable in Costa Rica: thus, it appears explicitly in the Convention on the Elimination of All Forms of Discrimination against Women (art. 14) and the Convention on the Rights of the Child (art. 24); it is also set forth in the International Conference on Population and Development in Cairo (principle 2) and declared in numerous other instruments of International Humanitarian Law. Within our Inter-American Human Rights System, the country is particularly bound in this regard by the provisions of article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (“Protocol of San Salvador” of 1988), which provides: “Article 11. Right to a Healthy Environment 1.-Everyone shall have the right to live in a healthy environment and to have access to basic public services.” A lack of resources does not justify the failure of public administrations to fulfill their duties in providing this basic service. (SALA CONSTITUCIONAL, decisions 2003-04654 and 2004-007779).
VIII.Regarding the specific case. In the case under review, the petitioner (recurrente) considers that his fundamental rights have been violated because he is a resident of Cipreses de Cartago, a community that receives drinking-water service through the ASADA de Santa Rosa de Oreamuno de Cartago. He claims that, since 2021, that association’s water supply system (acueducto) has experienced contamination problems involving a substance called “chlorothalonil,” as a result of which the Ministerio de Salud issued health orders (órdenes sanitarias) and ordered the closure of five water springs (nacientes), specifically the following springs: Piedra, Nombre730 , Birris, Agua Fría and Manuel Granados. He states that the aforementioned contamination problems were also confirmed through a study conducted jointly by IRET-UNA and the Laboratorio Nacional de Agua del Instituto Costarricense de Acueductos y Alcantarillados. Nevertheless, he complains that the contamination problems persist.
In this regard, it was deemed an undisputed fact that the protected party (amparado) is a resident of Cipreses de Cartago, a community that receives drinking-water service through the ASADA de Santa Rosa de Oreamuno de Cartago. It is also established that the ASADA de Santa Rosa de Oreamuno lies within an agricultural area and administers the Piedra, Nombre731 , Nombre730 , Birrís, Nombre732 , Agua Fría and Manuel Granados springs. In this respect, it was established that each of the respondent institutions is fully aware that the springs supplying water to the ASADA de Santa Rosa de Oreamuno are contaminated and that, for this reason, on 17 de octubre de 2022, an agreement was reached to close the water sources of the ASADA de Cipreses and the ASADA de Santa Rosa, because sampling conducted on 17 y 18 de octubre de 2022 detected the presence of metabolites of the fungicide chlorothalonil in five of the seven springs supplying that water system, prompting an alert to the Ministerio de Salud.
In light of this circumstance, on 2 de noviembre de 2022, together with ICCA officials and as part of the follow-up to the case involving contamination by metabolites of the pesticide chlorothalonil in water systems administered by the de Oreamuno, it was concluded that the ASADA Santa Rosa would be “resampled.” It should be noted that, on 3 de noviembre de 2022, after pesticide contamination of the water was identified, officials of the Ministerio de Salud, through official letter MS-DPRSA-0668-2022, requested coordination between the Dirección Regional Rectora de Salud Central Este and the Área Rectora de Salud de Oreamuno so that a health order would be issued prohibiting the use for human consumption of the contaminated springs used by the ASADA de Santa Rosa, and stated that: “(…) chlorothalonil is a fungicide approved for use in the country, registered under a wide variety of names and used in the farming of various products.
Once the chemical substance comes into contact with the environment, air, soil and/or microorganisms, it undergoes a series of changes resulting from the metabolism of living organisms or chemical processes that break it down into other molecules known as metabolites or degradation products; in the case of chlorothalonil, more than 7 different degradation molecules have been documented. In the specific case of the metabolites 1,3-dicarbamoyl-2,4,5,6 tetrachlorobenzene and 4-hydroxychlorothalonil, little documentation is available, particularly regarding their effects on human health, although somewhat more information exists regarding the environmental and ecotoxicological risks of 4-hydroxychlorothalonil. Internationally, in the European Union, a decision was made in 2019 to prohibit the use of the pesticide chlorothalonil because a critical problem was identified in connection with groundwater contamination by the pesticide’s metabolites.
The European Authority could not rule out a potential genotoxicity concern arising from the residues to which consumers would be exposed and identified a high risk to amphibians and fish in all assessed uses. Furthermore, chlorothalonil itself is classified as a carcinogen. The United States Environmental Protection Agency (EPA), on the other hand, has determined that chlorothalonil products do not pose risks to humans or the environment as long as authorized uses and the directions on the product label are followed. However, it has stated that studies are lacking to determine the risks posed by its metabolites. In conclusion, from a human-health perspective, there is a lack of scientific studies characterizing and identifying health risks associated with the consumption, ingestion or any other form of contact with the metabolite 1,3-dicarbamoyl-2,4,5,6 tetrachlorobenzene; however, studies do characterize chlorothalonil as highly toxic to aquatic life and moderately toxic to birds and earthworms.
Accordingly, any indication of contamination with this pesticide or metabolite must be treated with extreme caution, and the necessary measures must be taken to prevent its ingestion or contact, given the limited scientific evidence concerning human health and in reliance on studies confirming its ecotoxicity, as well as the risk to environmental health (…)”.
Subsequently, on 4 de noviembre de 2022, through official letter MS-DM-9862-2022, the then Ministra de Salud requested urgent coordination between the Dirección Regional Rectora de Salud Central Este and the Área Rectora de Salud de Oreamuno in order to implement the measures described in official letter MS-DPRSA-0668 and to issue an action plan to ICAA containing short-, medium-, and long-term measures to resolve the contamination situation. Accordingly, on 8 y 9 de noviembre de 2022, the ASADA Santa Rosa was resampled.
It is also established that the respondent Área Rectora de Salud issued and served nine health orders, in the following terms: MS-DRRSCE-DARSO-OS-0100-2022 to the President of the ASADA de Santa Rosa, for the purposes of: 1) informing the community, through as many communication channels as possible, that the drinking-water sources used by that ASADA from the Piedra, Nombre730 , Birris, Agua Fría and Manuel Granados springs may not be used for human consumption, food preparation or hygiene activities; and 2) informing the community of Santa Rosa about the situation involving metabolites of the pesticide chlorothalonil at the ASADA; MS-DRRSCE-DARSO-OS-0102-2022, MS-DRRSCE-DARSO-OS-0105-2022 and MS-DRRSCE-DARSO-OS-0108-2022, all addressed to the President of the Instituto Costarricense de Acueductos y Alcantarillados, for the purposes of:
In addition, it was established that, since 14 de diciembre de 2022, the Ministerio de Salud had requested the prohibition of the chlorothalonil molecule (molécula clorotalonil) and the initiation of a coordination process for that purpose between the Dirección de Productos de Interés Sanitario (DRPIS) and the senior officials of the Ministerio de Ambiente y Energía, as well as those of the Ministerio de Agricultura y Ganadería, in which the following was stated: “(…) According to PNUD estimates, Costa Rica has high pesticide consumption, coupled with a weakening of the agricultural extension and research services of the Ministerio de Agricultura y Ganadería, which creates risks of contamination of surface water (aguas superficiales) and groundwater (aguas subterráneas) that may jeopardize water sources intended for human consumption. Such events have occurred in Limón and the Zona Norte, with very serious economic and social implications, and these instances of contamination are now joined by those affecting the communities of Cipreses and Santa Rosa de Oreamuno.
Chlorothalonil is a molecule capable of producing metabolites once it enters the environment, with a high potential for contamination; according to the EFSA, even when this pesticide is used correctly, it will be capable of contaminating water sources, and there is insufficient toxicological information concerning its metabolites to determine potential health risks. This is demonstrated by the situations occurring in the Cipreses and Santa Rosa de Oreamuno water-supply systems, where, although chlorothalonil measurements have been taken, the chemical has not been detected; however, when its metabolites have been measured, high concentrations have been found, demonstrating the potential risk of contamination that chlorothalonil creates in water intended for human consumption. With respect to the technical capacity to measure pesticide residues, the country is lagging behind, as there is no direct relationship among the registered molecules, their metabolites, and the analytical techniques available to State laboratories for measuring them in surface-water and groundwater bodies.
Therefore, this situation becomes hazardous because chlorothalonil metabolites cannot be included systematically and according to schedule in the drinking-water monitoring activities carried out in the country. Moreover, any intervention or remediation and mitigation plan (plan de saneamiento y mitigación) is placed at a disadvantage because measurements cannot be taken to implement monitoring and compliance indicators. As a final conclusion, following a general assessment of the risks associated with the use of chlorothalonil, the lack of information concerning toxicity, and the risks of contamination of surface water and groundwater, a recommendation is issued to prohibit the chlorothalonil molecule; such prohibition would make it possible to begin a process of remediating the contaminated sources in Cipreses de Oreamuno and Santa Rosa de Oreamuno, with a view to seeking the future rehabilitation and reopening of the drinking-water sources, as well as safeguarding, as DIGECA indicates in its report, the constitutionally protected interests of human health, biodiversity, and the environment, in addition to preventing future contamination.
In response to this request to prohibit the molecule, it is recommended that a coordination process be initiated with the Dirección de Productos de Interés Sanitario (DRPIS) and the senior officials of the Ministerio de Ambiente y Energía, as well as those of the Ministerio de Agricultura y Ganadería, for the purpose of drafting a decree that will bring about a prohibition as quickly as possible (…)”.
Furthermore, it was established that, on 17 de marzo de 2023, the results were delivered from the resampling conducted on 8 y 9 de noviembre de 2022, once again showing the presence of metabolites of the fungicide chlorothalonil, but now in six of the seven springs (nacientes) supplying that water-supply system. In view of this circumstance, three additional health orders (órdenes sanitarias) were issued: MS-DRRSCE-DARSO-OS-0023-2023, addressed to the President of the ASADA, for the purpose of: 1) informing the community, through as many means of communication as possible, that the Nombre732 drinking-water source used by the ASADA de Santa Rosa de Oreamuno must not be used for human consumption, food preparation, or hygiene activities; and 2) coordinating with the Instituto Costarricense de Acueductos y Alcantarillados so that the water supplied to the population by tanker trucks or any other means of transportation comes from another source that does not contain contaminants; and MS-DRRSCE-DARSO-OS-0024-2023 and MS-DRRSCEDARSO-OS-0025-2023, served on the authorities of the Instituto Costarricense de Acueductos y Alcantarillados, requiring them to: 1) refrain from using the Nombre732 water source of the ASADA de Santa Rosa de Oreamuno to supply the population, by tanker trucks or any other means of transportation, with water used for human consumption, food preparation, or hygiene activities; and 2) coordinate with the President of the ASADA de Santa Rosa de Oreamuno so that the water supplied to the population by tanker trucks or any other means of transportation comes from another source that does not contain contaminants.
In this regard, the authorities of the Ministerio de Salud emphatically state that, as of the date on which the report in this proceeding was submitted and following service of the health orders of marzo de 2023, drinking water was being distributed by tanker trucks and pickup trucks equipped with water tanks, and storage tanks had been installed for household consumption; they supply the 853 service customers registered with the system, representing a total population of 3523 inhabitants, according to the Overcrowding Factor for the district of Santa Rosa de Oreamuno de Cartago determined by the INEC in the 2011 census. In this way, water fit for human consumption is being provided to the population pursuant to the precautionary principle (principio precautorio) in response to the problem identified in that community. Through joint work by the Dirección Regional Central Este, through Ing. Nelson Artavia Vega, and the Área Rectora de Salud de Oreamuno, through Dra. María José Lafuente González, the “Comisión Interinstitucional para el resguardo de las fuentes de agua utilizadas para consumo humano ubicadas en la Zona Norte de la provincia de Cartago” was formed.
This commission consists of representatives of ORAC Central Este AyA, UEN Gestión Ambiental del ICAA, Dirección de Agua, Ministerio de Agricultura y Ganadería, Comisión para el Ordenamiento y Manejo de la Cuenca Alta del Río Reventazón – COMCURE, Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía SINAC – MINAE, and Servicio Nacional de Salud Animal – SENASA. The commission’s objective is to establish a road map and work jointly to address the water-supply systems of the Zona Norte de Cartago, initially those in the cantons of Oreamuno and Alvarado. The commission already has a Preventive Measures Work Plan and a Reactive Measures Work Plan, which set forth a joint course of action to safeguard the water sources used for human consumption in that area.
Moreover, it was established that the Instituto Costarricense de Acueductos y Alcantarillados, together with the competent bodies of the Ministerio de Ambiente y Energía and the Servicio Fitosanitario del Estado of the Ministerio de Agricultura y Ganadería, has taken a series of actions for the purpose of participating in a coordinated manner and addressing each of the consequences of the contamination affecting the ASADA that falls within their respective areas of authority. Accordingly, they have issued a series of technical reports concerning the adverse effects of chlorothalonil and are part of the interinstitutional team addressing the situation. It should be noted that, as part of the actions taken, it was proposed that MAG, Ministerio de Salud, and MINAE, primarily, draft a decree pursuant to Artículo 29 of Ley 7664 to regulate the sale and/or use of chlorothalonil nationwide. The decree is proposed to establish restricted sale, authorized solely under a professional prescription, so that the product may be marketed only by companies that have agricultural technical supervisors (regentes agrícolas); this would require the corresponding accountability of those supervisors and oversight by the Colegio de Ingenieros Agrónomos de Costa Rica.
This action would be a measure adopted pursuant to the precautionary principle, similar to that applied by the Ministerio de Salud when issuing the health order to close the ASADAS, and pursuant to the pro natura principle (principio pro natura), but supported by the technical evidence concerning the detection in the sources of the metabolite 1,3-dicarbamoil-2,4,5,6tetraclorobenceno (derived from the fungicide chlorothalonil). Finally, the authorities of the Ministerio de Agricultura y Ganadería clearly stated that the Servicio Fitosanitario del Estado is unable to develop coordinated actions with performance indicators for the purpose of measuring, monitoring, and comparing the results obtained through the “Plan de manejo remedial para implementar en fuentes de agua de la ASADA Cipreses de Oreamuno” to determine whether contamination has been mitigated or reduced so as to achieve “remediation” (saneamiento) of the water sources.
Based on the foregoing, it should first be clarified that, in the case decided by the Sala in judgment No. 2022-026065 at 9:45 hours on 4 de noviembre de 2022, it was established that the administrative authorities had failed to address the matter and implement concrete actions to resolve the alleged problem, despite being aware of the contamination affecting the wells that supplied the ASADA de Cipreses. In the case under review, although it has been established that, in view of the contamination in the springs of the ASADA de Santa Rosa de Oreamuno, the respondent authorities have adopted concrete actions aimed not only at preventing human consumption but also at resolving the contamination problem, the fact remains that each of those actions has merely been set forth in plans intended for future implementation or, as of this date, remains nothing more than a recommendation.
In this regard, of particular relevance to the resolution of this matter is the report prepared on 14 de abril de 2023 by the Ministerio de Salud, jointly with the Ministerio de Ambiente y Energía and the Instituto Costarricense de Acueductos y Alcantarillados, entitled “Informe Técnico Clorotalonil,” which issued a series of recommendations, including: “(…) Recommendations 1. It is recommended that oversight and control by the Servicio Fitosanitario del Estado be increased and that the replacement of chlorothalonil with safer pesticides (plaguicidas) and the adoption of Good Agricultural Practices (Buenas Prácticas Agrícolas) be promoted. This will ensure protection of the environment and the health of the population in this and other regions of the country where this pesticide is used. 2. It is recommended that the Laboratorio Nacional de Aguas be strengthened so that it has the resources necessary to quantify chlorothalonil metabolites and so that a nationwide monitoring and control program for chlorothalonil and its metabolites in water intended for human consumption (agua para consumo humano) can be implemented. 3.
Therefore, in addition to the recommendations issued in official communication DIGECA-563-2022, it is recommended that the SFE conduct a survey of the pesticides most widely used in the country and that the analysis of residues in water sources, soils, and plants be prioritized according to updated import volumes, including the metabolites of these pesticides currently in widespread use. 4. It is the responsibility of the Costa Rican State to regulate the use of chemical substances in agriculture so as to ensure their proper management and use without posing unacceptable risks to human health and the environment. Although some substances may be used in accordance with usage recommendations, it is important to consider the potential risks posed by the metabolites and residues generated and to apply the precautionary principle (principio precautorio) in order to make informed decisions and protect the health and well-being of the population and the ecosystem. 5.
The institutions responsible for pesticide regulation and control must take urgent measures to prevent and mitigate the adverse impacts associated with the use of this pesticide. This entails implementing effective oversight strategies, promoting sustainable agricultural practices, and gradually eliminating chlorothalonil from the country’s agricultural industry. Ultimately, protecting human health and the environment must be the primary objective of any pesticide-management strategy. 6. To protect bodies of water (cuerpos de agua) and reduce the risk of contamination from pesticide use, it is recommended that localized application systems be promoted and that the surrounding protection zone (zona de protección) be respected, as established in artículo 33 of Ley N° 7575, Ley Forestal, for the protected areas (áreas de protección) of bodies of water defined in that law. These measures promote the protection of bodies of water and the health of the population that depends on them. 7.
Based on the hazard warnings concerning chlorothalonil and the concern that products registered on the basis of this Technical-Grade Active Ingredient (Ingrediente Activo de Grado Técnico, IAGT) lack DIGECA’s environmental endorsement, it is considered essential, in order to safeguard the environment, that the registrations currently in force for products based on this pesticide be canceled. The foregoing is in accordance with the provisions of sections ...04 and ...05 of Placa50 and 16.2 of Placa51 and artículos 29 and 30 of Ley 7664 Ley de Protección Fitosanitaria, concerning the suspension and cancellation of registrations. 8. Consistent with the recommendations set forth and the risks analyzed, it is recommended that the use of chlorothalonil be prohibited in Costa Rica, in line with the measures adopted by the Unión Europea. Safety measures and agricultural alternatives must be implemented that minimize the exposure of workers and consumers, while ensuring the protection of water sources, the environment, and public health (…)” (emphasis not in the original).
It should be noted that, although efforts have been made to achieve interinstitutional coordination and the authorities have prepared reports such as the one transcribed above—which clearly sets forth the risks and implications of continuing to use chlorothalonil as an agrochemical (agroquímico) in our country and issues a series of sound technical recommendations for addressing the problem alleged in this amparo proceeding (recurso de amparo)—there is no evidence whatsoever that these recommendations had been fully implemented by the date on which the report in this proceeding was submitted. Multiple health orders (órdenes sanitarias) have admittedly also been issued, and the Nombre733 of Cipreses and Santa Rosa de Oreamuno were immediately closed; however, as recently as marzo de 2023, contamination was being discovered in a sixth spring (naciente) supplying the ASADA of Santa Rosa, which until then had been regarded as a clean spring.
This means that, despite the measures taken, the problem described persists, and none of the actions taken has yet succeeded in mitigating the severe impact caused by the agrochemical on the water springs or in resolving the situation, since the residents of the area continue to receive water by tanker trucks, as they have since the first order issued by this Sala in noviembre de 2022, and there is no evidence that, in the near future, they will once again be able to freely enjoy uncontaminated drinking water (agua potable), as they did previously.
It should be observed that this case involves not only the risk of consuming contaminated water; the technical reports in the case record (expediente) also show that there is a risk that this contaminated water may be used to irrigate crops of celery, broccoli, coffee, onions, sweet peppers, cauliflower, beans, tomatoes, carrots, cabbage, potatoes, and other products grown in the northern part of the province of Cartago. The risk also extends to all species found in the area, such as fish, amphibians, and others; fish are likewise intended for human consumption, and consumers would be exposed to the residues remaining in all these products and aquatic species. Therefore, as analyzed in this judgment, the impact could be far greater than the preliminary evidence indicates.
It is certainly not for this Sala to determine, through this amparo proceeding, whether the agrochemical alleged by the petitioner (recurrente) is harmful, the severity of the consequences that its use entails for the environment and human beings, or, consequently, whether its sale and use in the country should be prohibited (see judgment No. 7009-2019, at 9:20 hours on 26 de abril de 2019). Nevertheless, this Sala is responsible for ensuring that State institutions act in a coordinated manner to protect the environment, health, and drinking water. It should be noted that, unlike other cases in which this Sala has considered the use of an agrochemical or pesticide—such as the use of glyphosate, which was analyzed in judgment No. 7009-2019 and concerning which the respondent authorities themselves held a series of conflicting technical opinions—in the case at bar (sub lite), each of the authorities, agencies, and institutions involved has expressed concern regarding the use of chlorothalonil and its risks and impacts on the environment and health.
Of importance to the resolution of this matter are the provisions of the following articles of the Ley General de Salud:
“ARTICLE 2.- It is an essential function of the State to safeguard the health of the population. The Executive Branch, through the Ministerio de Salubridad Pública, hereinafter referred to in this law in abbreviated form as the ‘Ministerio,’ is responsible for defining national health policy and for organizing, planning, and coordinating all public and private health-related activities, as well as carrying out those activities assigned to it by law. It shall have the power to issue autonomous regulations (reglamentos autónomos) in these matters. (…)
ARTICLE 239.- No natural or legal person (persona natural o jurídica) may import, manufacture, handle, store, sell, transport, distribute, or supply toxic substances or products, or hazardous substances, products, or objects of a radioactive, oxidizing, flammable, corrosive, irritating, or other nature declared hazardous by the Ministerio, where they pose a risk of or cause harm to human health or life, without strict compliance with the regulatory requirements or any special requirements that the Ministerio may establish to prevent such risk or danger. (…)
ARTICLE 264.- Water constitutes a public-utility resource (bien de utilidad pública), and its use for human consumption shall take priority over any other use. (…)
ARTICLE 293.- Every natural or legal person is required to exercise the utmost diligence in complying with legal and regulatory provisions or with special directives issued by the competent authority, in order to prevent or control atmospheric and environmental pollution in places intended for housing, work, or recreation. (…)
ARTICLE 337.- The health authorities shall have exclusive responsibility for enforcing and monitoring compliance with the provisions of this law and its regulations, without prejudice to the powers and obligations granted and imposed on other public bodies by special laws within their respective areas of authority. (…)
Article 338 bis.- Coordination among health authorities. Officials of the Ministerio de Salud and all other health authorities shall carry out health-control and health-protection activities in a coordinated manner, under penalty of dismissal without employer liability. (…)
ARTICLE 341.- Within the aforementioned powers and jurisdictions, they may also order and adopt the special measures authorized by this law to prevent risks to or harm to human health, prevent such risks or harm from spreading or worsening, and halt the continuation or recurrence of violations by private parties. (…)
ARTICLE 342.- The Ministro shall likewise be responsible for issuing the technical health standards (normas técnicas de salud) with which natural or legal persons governed by private or public law must comply in matters for which this law so requires. (…)
Article 343.- Every public, semipublic, or private institution or establishment that carries out health-related activities, whether involving the prevention, promotion, preservation, or restoration of individuals’ physical and mental health or patient rehabilitation, shall be subject to the technical standards issued by the Ministerio within the scope of its powers and to the technical control and oversight of the health authorities. (…)
ARTICLE 344.- The public or semipublic bodies of decentralized or deconcentrated administration, to any degree, that administer services of public interest—such as the supply of drinking water, sewerage, and solid-waste collection—or other services that, by the nature of their functions, may affect or seriously harm the health of the population through technical inefficiency or inadequate services, shall likewise be subject to the standards, control, and heightened oversight referred to in the preceding article. (…)” (emphasis not in the original).
Consistent with the provisions of the Ley General de Salud, the Reglamento para la calidad de Agua Potable, No. 38924-S, provides:
“(…) Article 4. Definitions and Acronyms. For the purposes of this regulation, the following definitions and acronyms are established (…) hh) Drinking-water quality surveillance (vigilancia de la calidad del agua potable): Ongoing public-health assessment, conducted by the Ministerio de Salud, of operating entities (entes operadores), in order to ensure the safety, harmlessness, and acceptability of the drinking-water supply from the source’s area of influence to the distribution system (…)” Article 16. State Surveillance. Each DARS shall conduct random sampling of operating entities located within the geographical area under its jurisdiction, as part of a cross-check (control cruzado). At least one of the semiannual samplings of the selected water-supply system must be conducted using laboratories that hold a valid Sanitary Operating Permit (Permiso Sanitario de Funcionamiento) and have accredited tests for the respective analyses.
(…) The cross-check report shall replace the water-quality report for the corresponding period. If the results show noncompliance with one or more parameters, the DARS shall issue a sanitary order (orden sanitaria), requiring the submission of a timetable for the corrective-action plan (…)” (emphasis not in the original).
It follows from the provisions described above that, in Costa Rica, the Ministerio de Salud is the authority required to define national health policy. Furthermore, its powers include inspecting and monitoring, through the Áreas Rectoras de Salud in each locality, the quality of the drinking water being supplied to consumers in every area of the country, as well as issuing such orders and implementing such actions as it considers appropriate to carry out this surveillance. It may also coordinate with the other authorities, according to their respective powers, any other action required to protect the water provided to users of the various drinking-water services nationwide and to protect their health and lives.
Against this backdrop, the facts and claims deemed proven in this amparo proceeding (recurso de amparo) show that, despite the efforts made by the respondent institutions and their interest in regulating the matter, the alleged problem persists to date, and none of the actions currently being taken indicates that a solution is near. It should be noted that none of the reports submitted to this Chamber clearly and conclusively establishes the extent of the damage caused or how the damage may be counteracted in order to find a genuine and effective solution to the problem confronting local residents and the area’s environment in general. Nor was it possible to verify the existence of any final agreement aimed at regulating the application of chlorothalonil in the country. It is therefore important that coordinated action by the different authorities lead to a determination of the matter as soon as possible.
It should be noted that the authorities of the Ministerio de Salud themselves emphatically state that “a remediation process (proceso de saneamiento) may be initiated for the contaminated sources in Cipreses de Oreamuno and Santa Rosa de Oreamuno, with a view to the future rehabilitation and reopening of the drinking-water sources.” Nevertheless, there is no evidence that this process has begun, further substantiating the need for coordinated collaboration and verification among all the institutions involved, allowing techniques to be used and implemented jointly to achieve treatment capable of carrying out the greatly needed remediation of the contaminated water sources and addressing the other aspects entailed by this process. These aspects include, of course, the proper regulation in the country of chlorothalonil use or, alternatively, the prohibition of that product, so as to prevent future situations such as those currently being experienced in the communities affected by the aforementioned contamination.
As previously stated, such coordination and verification are the responsibility of the Ministerio de Salud, as the authority charged with monitoring drinking-water quality in our country, pursuant to the powers enumerated in the applicable provisions cited above. This will enable that Ministry to address the recommendations made in the unnumbered report entitled “Informe Técnico Clorotalonil,” issued on 14 de abril de 2023, and to undertake such coordination as it deems necessary with the other authorities involved, according to their respective powers. This could even entail the technical possibility of remediating the water sources, as previously considered by this jurisdiction (see, to that effect, judgments numbered 2020-6275 at 9:20 a.m. on 27 de marzo de 2020, 2019-7690 at 9:15 a.m. on 3 de mayo de 2019, 2019-695 at 9:15 a.m. on 18 de enero de 2019, 2009-9041 at 10:30 a.m. on 29 de mayo de 2009, and 2009-9040 at 10:29 a.m. on 29 de mayo de 2009).
In view of the foregoing, the appropriate course is to grant the petition, subject to the considerations set forth in the operative portion (parte dispositiva) of this judgment.
IX.Note by Justice Salazar Alvarado. In environmental matters, it is the undersigned’s view that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative courts. Nevertheless, I do address the merits when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (Article 50 of the Constitución Política), as is the case here, where it is alleged that the respondent authorities have failed to fulfill their duty to protect health and the environment because they have not yet ended the alleged contamination problem arising from water operations involving the use of a pesticide. This threatens to infringe the right to enjoy a healthy and ecologically balanced environment and a decent quality of life.
X.Documentation submitted to the case file (expediente). The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, telematic, or new-technology device, they must retrieve them from the Clerk’s Office within a maximum period of thirty business days counted from notice of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in Session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial N° 19 of 26 de enero del 2012, as well as the decision approved by the Consejo Superior del Poder Judicial at Session N° 43-12, held on 3 de mayo del 2012, Article LXXXI.
Por tanto:
The petition is granted. It is ordered: 1) that Alexei Carrillo Villegas and Fiorella Fait Wong, respectively Acting Minister of Health and Acting Director of the Área Rectora de Salud de Oreamuno, or whoever may hold those positions in their stead, pursuant to the powers conferred on them by current legislation, immediately establish all appropriate coordination mechanisms with the authorities of the Ministerio de Agricultura y Ganadería, the Ministerio de Ambiente y Energía, and the Instituto Costarricense de Acueductos y Alcantarillados, within their respective spheres of authority, so that, within six months counted from notice of this judgment and in accordance with the parameters established by the Ministerio de Salud, they adopt and implement the recommendations contained in the unnumbered report of 14 de abril de 2023, issued by the Ministerio de Salud, the Ministerio de Ambiente y Energía, and the Instituto Costarricense de Acueductos y Alcantarillado, entitled “Informe Técnico Clorotalonil,” in order to guarantee the right to health and life; monitor compliance with those recommendations; and take the appropriate measures to ensure their proper and timely implementation; and 2) that Jorge Zapata Arroyo and José Sánchez Redondo, respectively General Manager of the Instituto Costarricense de Acueductos y Alcantarillados and President vested with authority to represent the ASADA de Santa Rosa de Oreamuno de Cartago in and out of court, or whoever may hold those positions in their stead, immediately maintain and guarantee the provision of drinking water for human consumption through the appropriate means, without using any of the contaminated water sources for that purpose, and maintain that arrangement until service can be properly restored through the usual means without compromising safety and health, and after obtaining authorization from the Ministerio de Salud.
The foregoing is ordered with the warning that failure to comply with this order shall constitute the offense of disobedience and that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that they are required to comply with or enforce, and fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or twenty to sixty fine-days, provided that the offense is not subject to a more severe penalty. The State and the Instituto Costarricense de Acueductos y Alcantarillados are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, to be assessed during enforcement of the judgment before the administrative litigation court. The ASADA de Santa Rosa de Oreamuno de Cartago is likewise ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, to be assessed during enforcement of the judgment before the civil court.
Justice Salazar Alvarado files a note. Justice Garro Vargas dissents as to the enforcement of the first order in this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, directs that enforcement take place before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in Articles 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be transmitted so that proceedings to enforce this ruling may be initiated. Notice shall be given.- Nombre318 .

Res. N.º PHO665 Partial dissenting opinion (voto salvado parcial) of Justice Garro Vargas regarding enforcement of the first order in this judgment.
Although I agree with the majority of the Chamber that the petition should be granted, I disagree as to the court before which the enforcement phase of the matter should be lodged with respect to the first order, because the provisions governing this constitutional jurisdiction do not provide adequate mechanisms for properly monitoring that order.
As is well known, pursuant to the Ley de la Jurisdicción Constitucional (LJC), enforcement of orders issued by the Sala Constitucional is, in principle, to be overseen by the Chamber itself. However, Article 56 of the LJC provides for exceptional circumstances in which the Chamber itself may order that enforcement of the judgment be lodged with the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa). The provision in question states as follows:
“Article 56. The enforcement of judgments (ejecución de las sentencias) shall be the responsibility of the Sala Constitucional, except with respect to the quantification and payment of damages and monetary liabilities (liquidación y cumplimiento de indemnizaciones y responsabilidades pecuniarias), or regarding other matters that the Chamber itself deems appropriate, in which case enforcement shall take place through administrative litigation proceedings (vía contencioso administrativa), pursuant to the judgment-enforcement procedure provided for in the law governing that jurisdiction.” (Emphasis not in the original).
It should be recalled that the bill debated in connection with the LJC originally provided as follows:
“Article 56. Judgments in favor of the petitioner shall be enforced through administrative litigation proceedings, pursuant to the judgment-enforcement procedure provided for in the law governing that jurisdiction.” (Emphasis not in the original).
However, the text was amended by motion so that the provision would be consistent with the rules set forth in Article 153 of the Constitución Política, but the following explanation was given:
“THE SECRETARY:
Motion No. 68 (32-19), submitted by Deputy Chacón Jiménez:
“Article 57 (formerly 56): so that the text shall read as follows: ‘the enforcement of judgments shall be the responsibility of the Sala Constitucional, except with respect to the quantification and payment of damages or monetary liabilities, or regarding other matters that the Chamber itself deems appropriate, in which case enforcement shall take place through administrative litigation proceedings, pursuant to the judgment-enforcement procedure provided for in the law governing that jurisdiction.’” THE PRESIDENT:

There was a contradiction here with the general principle that courts enforce their own judgments, since it referred the entire enforcement process to the administrative litigation jurisdiction (Jurisdicción Contencioso Administrativa); that left the other articles authorizing the Chamber to enforce them without effect.

That section says: “or regarding other matters that the Chamber itself deems appropriate...”; what does that refer to?
Dr. Piza Escalante:
The idea is that, during the judgment-enforcement proceedings, the Chamber should decide whatever it considers to fall within its purview. Everything else is referred to administrative litigation proceedings.

Based on the foregoing, it is clear that the LJC itself authorizes this Chamber to decide what it considers to fall within its purview and, should it deem appropriate, it may refer to the administrative litigation jurisdiction those matters that it determines should be handled there.
In this specific case, the first order states as follows:
“1). Alexei Carrillo Villegas and Fiorella Fait Wong, in their respective capacities as Acting Minister of Health and Acting Director of the Área Rectora de Salud de Oreamuno, or whoever may hold those positions in their stead, are ordered, in accordance with the powers granted to them by the legislation in force, to immediately establish all appropriate coordination mechanisms with the authorities of the Ministerio de Agricultura y Ganadería, the Ministerio de Ambiente y Energía, and the Instituto Costarricense de Acueductos y Alcantarillados, within their respective spheres of authority, so that, within six months from service of this judgment and in accordance with the parameters established by the Ministerio de Salud, they adopt and implement the recommendations contained in the unnumbered report dated 14 de abril de 2023, issued by the Ministerio de Salud, the Ministerio de Ambiente y Energía, and the Instituto Costarricense de Acueductos y Alcantarillado, entitled ‘Chlorothalonil Technical Report,’ in order to guarantee the right to health and life of all persons; monitor the implementation of those recommendations; and take the appropriate measures to ensure their proper and timely fulfillment.” With respect to that report, proven fact 30) of the judgment states:
“On April 14, 2023, the Ministerio de Salud, together with the Ministerio de Ambiente y Energía and the Instituto Costarricense de Acueductos y Alcantarillados, issued the ‘Chlorothalonil Technical Report,’ which reached the following conclusions and recommendations: ‘(…) Conclusions 1. The Sala Constitucional has recognized on several occasions that both public health and the right to a healthy and ecologically balanced environment are fundamental rights recognized at both the constitutional and international levels. The legitimate exercise of these rights requires that resources be used rationally, and the State is responsible for protecting the environment in accordance with the precautionary principle (principio precautorio) governing environmental matters. The administrative authorities must conduct rigorous and detailed environmental assessments (evaluaciones ambientales) and share the results with the affected population to ensure that economic activities having an environmental impact do not pose a risk or threat of permanent and irreversible harm to the environment.
Failure to address and comply with these aspects, as defined by law and case law, may result in the violation of the right to a healthy environment and to public health. In this regard, the Costa Rican State has the power and duty to ensure the effective and timely protection of these fundamental rights, thereby improving the population’s standard of living. 2. Chlorothalonil is used primarily as a fungicide on a wide range of crops, including vegetables and fruit. More than 20 metabolites of this fungicide have been identified, including 4-hydroxychlorothalonil and 3-carbamyl-2,4,5-trichlorobenzoic acid, which are moderately mobile and persistent. 3. Chlorothalonil has been banned in the European Union because of its carcinogenic potential and its capacity to contaminate groundwater with metabolites resulting from its degradation. Although chlorothalonil has been banned, its metabolites continue to be a persistent problem in the environment and in drinking-water supplies.
In Switzerland, chlorothalonil by-products have been detected in groundwater and drinking water in several cantons, at levels exceeding the legal standards established for drinking water. Chlorothalonil metabolites have also been found in surface waters such as the Rhine River and Lake Zurich. 4. Chlorothalonil is a molecule that, although it has a low leaching potential, can be highly toxic to fish and aquatic invertebrates when applied during rainy periods. In addition, its degradation products, such as 4-hydroxychlorothalonil, may be toxic to mammals and birds, including reproductive and carcinogenic effects. Residues of chlorothalonil metabolites have also been found in foods such as blueberries up to 76 days after application. 5. In light of the evidence presented, it may be concluded that chlorothalonil poses significant risks to human health and the environment. The United States Environmental Protection Agency has classified chlorothalonil as a possible human carcinogen and a possible reproductive and developmental toxicant, and exposure to this compound may cause irritation of the skin, eyes, and respiratory tract, as well as nausea, headache, and dizziness.
For its part, the European Food Safety Authority has identified critical concerns; moreover, the assessment of the risk to consumers from dietary exposure could not be completed because of insufficient data in the record, suggesting that the use of this fungicide may pose an unknown risk to public health. 6. In conclusion, the assessment conducted by EFSA indicates that chronic dietary exposure to chlorothalonil may pose a risk to human health, particularly for the most vulnerable population groups. In addition, highly contaminating chlorothalonil metabolites have been found in water sources intended for human consumption, demonstrating the potential risk of contamination. Although little is yet known about the effects these compounds may have on human health, the precautionary principle must be applied in decision-making, and preventive measures must be taken to minimize exposure to these compounds.
The ban on the use of chlorothalonil in the European Union is an example of how the precautionary principle is being applied to protect human health and the environment. 7. In the province of Cartago, Costa Rica, there are eight springs (nacientes) intended for human consumption that are being contaminated because agricultural and livestock activities have encroached upon protection zones (zonas de protección) and aquifer-recharge areas (zonas de recarga de acuíferos). Chlorothalonil metabolites have been detected in the Cipreses and Santa Rosa water-supply systems in the canton of Oreamuno. It is therefore necessary to take measures to prevent the contamination of additional water sources and to protect public health. 8. It is concluded that chlorothalonil raises environmental concerns, principally because of its acute and chronic toxicity to aquatic organisms and the danger posed by its metabolites due to their potential to contaminate both surface water and groundwater.
Moreover, this pesticide is commonly used on vegetables, and it is concerning that the country lacks the technical capacity to properly survey and monitor its metabolites in soil and water, as is also the case with other pesticides currently in widespread use. 9. In response to the problem posed by the use of the pesticide chlorothalonil in water sources, MAG proposes options such as replacing it with other pesticides having the same mechanism of action, promoting localized application systems, and respecting the surrounding protection zone. 10. There is evidence of weakened oversight, regulation, and control by MAG over the use of the pesticide chlorothalonil in Costa Rica, which has created an environmental and public-health problem in the area where it is applied. 11. Replacing chlorothalonil with biopesticides or biological control agents is an alternative that is not extensively addressed by MAG in its remedial plan.
This alternative must, however, be analyzed on a case-by-case basis by identifying control agents for each pest and crop and conducting efficacy tests. 12. It is necessary to identify the crops in the area and the pests being treated and to confirm the corresponding registrations with SFE in order to understand the problem caused by chlorothalonil. Work plans must be established to determine whether Good Agricultural Practices (Buenas Prácticas Agrícolas, BPA) are being properly implemented and whether substitution with other pesticides and/or biopesticides is possible. It should be noted that replacing chlorothalonil does not guarantee the complete elimination of pesticide use, because some alternative products are being reassessed due to their effects on health and the environment. Recommendations 1. It is recommended that the Servicio Fitosanitario del Estado increase oversight and control and promote the replacement of chlorothalonil with safer pesticides and the adoption of Good Agricultural Practices.
This will ensure the protection of the environment and public health in this and other regions of the country where this pesticide is used. 2. It is recommended that the Laboratorio Nacional de Aguas be strengthened so that it has the resources necessary to quantify chlorothalonil metabolites and so that a nationwide chlorothalonil and metabolite surveillance and control program for water intended for human consumption can be implemented. 3. Therefore, in addition to the recommendations issued in official letter DIGECA-563-2022, it is recommended that SFE conduct an inventory of the pesticides most widely used in the country and that residue analysis in water sources, soil, and plants be prioritized according to updated import volumes, including the metabolites of these pesticides currently in widespread use. 4. The Costa Rican State is responsible for regulating the use of chemicals in agriculture in a manner that ensures their proper management and use without posing unacceptable risks to human health and the environment.
Although some substances may be used in accordance with their usage recommendations, it is important to consider the potential risks posed by the metabolites and residues generated and to apply the precautionary principle in order to make informed decisions and protect the health and well-being of the population and the ecosystem. 5. The institutions responsible for pesticide regulation and control must take urgent measures to prevent and mitigate the adverse impacts associated with the use of this pesticide. This entails implementing effective oversight strategies, promoting sustainable agricultural practices, and gradually eliminating chlorothalonil from the country’s agricultural industry. Ultimately, protecting human health and the environment must be the primary objective of any pesticide-management strategy. 6. To protect bodies of water and reduce the risk of contamination from pesticide use, it is recommended that localized application systems be promoted and that the surrounding protection zone be respected, as established by Article 33 of Ley N° 7575, Ley Forestal, for the water-body protection areas defined in that law.
These measures promote the protection of bodies of water and the health of the population that depends on them. 7. Based on the chlorothalonil hazard alerts and the concern that products registered on the basis of this Technical-Grade Active Ingredient (Ingrediente Activo de Grado Técnico, IAGT) lack DIGECA’s environmental approval, it is considered essential, in the interest of safeguarding the environment, that the current registrations based on this pesticide be canceled. The foregoing is in accordance with the provisions of sections ...04 and ...05 of Placa50 and section 16.2 of Placa51, as well as Articles 29 and 30 of Ley 7664 Ley de Protección Fitosanitaria, concerning the suspension and cancellation of registrations. 8. Consistent with the recommendations set out above and the risks analyzed, it is recommended that the use of chlorothalonil be prohibited in Costa Rica, in line with the measures adopted by the European Union.
Safety measures and agricultural alternatives must be implemented to minimize worker and consumer exposure, while also ensuring the protection of water sources, the environment, and public health (…)’.” It is clear that this is an order of extreme complexity, the enforcement of which can hardly be effectively supervised by this Sala Constitucional. By contrast, the provisions of the Código Procesal Contencioso-Administrativo concerning enforcement (Article 155 et seq.) offer clear advantages, such as the ability to require schedules, impose fines, establish liability, monitor stages of compliance, and so forth. Accordingly, pursuant to Article 56 of the LJC, it is my view that this first order must be enforced before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under that Code’s rules for the enforcement of judgments (ejecución de sentencia).
For the foregoing reasons, I partially dissent with respect to the enforcement of the first order in this judgment, which, pursuant to Article 56 of the LJC, must be brought before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda. To that end, I order that a copy of this decision be transmitted so that proceedings to enforce this judgment may be commenced.

Recurso de amparo interpuesto por Nombre729 , cédula de identidad No. CED231, contra el MINISTERIO DE SALUD, el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS -ICAA-, la ASADA DE SANTA ROSA DE OREAMUNO DE CARTAGO, el MINISTERIO DE AMBIENTE Y ENERGÍA, el SISTEMA NACIONAL DE ÁREA DE CONSERVACIÓN y el MINISTERIO DE AGRICULTURA Y GANADERÍA.
Resultando:
Redacta Magistrado Araya García; y,
Considerando:
I.Sobre la admisibilidad del recurso de amparo contra sujeto de derecho privado. La Ley de la Jurisdicción Constitucional, en su artículo 57, estipula bajo qué supuestos es admisible el amparo contra las acciones u omisiones de sujetos de derecho privado, y señala que resulta admisible este tipo de demanda cuando éstos actúen o deban actuar en ejercicio de funciones o potestades públicas, o, se encuentren, de hecho o de derecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2° inciso a) de la misma Ley. En el caso concreto, se cumplen esos presupuestos, pues se acusa que la ASADA de Santa Rosa de Oreamuno, está en una posición de poder respecto del recurrente, en virtud de la denuncia de contaminación de agua que suministra la recurrida y la cual presuntamente no ha sido resuelta.
II.Objeto del recurso. El recurrente estima vulnerados sus derechos fundamentales, toda vez que, que es vecino de Cipreses de Cartago, comunidad que recibe el servicio de agua potable por medio de la ASADA de Santa Rosa de Oreamuno de Cartago. Reclama que, desde el año 2021, el acueducto de esa asociación cuenta con problemas de contaminación con una sustancia denominada "clorotalonil", a partir de lo cual el Ministerio de Salud giró órdenes sanitarias y de clausura de cinco nacientes de agua, propiamente las siguientes nacientes: Piedra, Nombre730 , Birris, Agua Fría y Manuel Granados. Menciona que; además, los problemas de contaminación de cita fueron confirmados a través de un estudio realizado conjuntamente por IRET-UNA y el Laboratorio Nacional de Agua del Instituto Costarricense de Acueductos y Alcantarillados. No obstante, aqueja que los problemas de contaminación persisten.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
A.- Sobre la ASADA de Santa Rosa de Oreamuno:
B.- Sobre el Área Rectora de Salud de Oreamuno y el Ministerio de Salud:
Para el caso específico de los metabolitos 1,3-dicarbamoil-2,4,5,6 tetraclorobenceno y el 4- hidroxiclorotalonil existe poca documentación disponible, en especial sobre la afectación para la salud humana, existiendo un poco más de información sobre riesgos ambientales y ecotóxicos para el 4- hidroxiclorotalonil. A nivel internacional en la Unión Europea se decidió en el 2019 prohibir el uso del plaguicida clorotalonil porque se identificó un problema crítico en relación con la contaminación de las aguas subterráneas por los metabolitos del plaguicida. La Autoridad Europea no pudo descartar un posible problema de genotoxicidad de los residuos a los que se verían expuestos los consumidores y detectó un alto riesgo para los anfibios y los peces en todos los usos evaluados. Asimismo, el clorotalonil, como tal, está clasificado como carcinógeno. Por otro lado, la Agencia de Protección Ambiental de los Estados Unidos (EPA) ha determinado que los productos del clorotalonil no suponen riesgos para los seres humanos o el medio ambiente mientras que se sigan los usos autorizados y las indicaciones de la etiqueta del producto.
Sin embargo, ha declarado que existe un faltante de estudios para determinar riesgos por sus metabolitos. En conclusión, desde el punto de vista de salud humana existe una deficiencia en estudios científicos que caractericen e identifiquen riesgos asociados a la salud por el consumo, ingesta o cualquier otro tipo de contacto del metabolito 1,3-dicarbamoil-2,4,5,6 tetraclorobenceno, sin embargo, sí existen estudios que caracterizan al clorotalonil como altamente tóxico para la vida acuática y moderadamente tóxico en aves y lombrices. Por lo que se debe de considerar con extrema precaución cualquier indicio de contaminación con este plaguicida o metabolito y tomar las medidas necesarias para evitar su ingesta o contacto en vista de la poca evidencia científica que existe referente a la salud humana y apoyarse en los estudios que confirman la ecotoxicidad que presenta, así como el riesgo para la salud ambiental (…)” (ver informe rendido bajo juramento y prueba aportada al expediente judicial).
Se puede considerar el uso del agua de estas fuentes para el funcionamiento de inodoros y otras actividades de limpieza y desinfección intradomiciliaria. • Se emita una Orden Sanitaria al Instituto Costarricense de Acueductos y Alcantarillados para que se brinden agua a la comunidad de manera inmediata por medio de camiones cisterna o cualquier otro mecanismo que aseguro disponibilidad de agua segura para consumo humano en la población de Santa Rosa. • Se emita una Orden Sanitaria a la ASADA Santa Rosa y al Instituto Costarricense de Acueductos y Alcantarillados para que se comunique a la comunidad de manera correcta y asertiva, así como por la mayor cantidad de canales posibles la situación que presenta la ASADA Santa Rosa sobre los metabolitos del plaguicida Clorotalonil y la aplicación del principio de precaución con el fin de prevenir problemas de salud en la población además que se realice la aclaración que el agua para consumo humano, preparación de alimentos e higiene vendrá exclusivamente de los camiones cisterna, mientras que el agua que provenga del acueducto puede considerarse para el funcionamiento de inodoros y otras actividades de limpieza y desinfección intradomiciliaria. • Solicitar mediante Orden Sanitaria un Plan de Acción con acciones a corto, mediano y largo plazo al Instituto Costarricense de Acueductos y Alcantarillados en un plazo considerable de ley donde se indique los pasos a seguir para solucionar la situación de contaminación de la ASADA de Santa Rosa, ya sea mediante interconexiones con otras ASADAS, búsqueda de nuevas fuentes, aplicación de sistemas de tratamiento entre otras, según sea determinado por su rectoría técnica en el agua potable.
Cabe la pena mencionar que en el sistema 1 la Naciente Nombre731 y en el sistema 2 la Nombre732 quedan habilitada para su uso, por lo que pueden representar una opción para brindar agua segura a la población de Santa Rosa siempre que estos sistemas desconecten las otras nacientes contaminadas (…)” (ver informe rendido bajo juramento y prueba aportada al expediente).
El Clorotalonil es una molécula con capacidad para producir metabolitos una vez ingresa al ambiente, con un alto potencial de contaminación y según la EFSA aun cuando se utilice de manera correcta este plaguicida tendrá la capacidad de contaminar fuentes de agua y que sus metabolitos no cuentan con información toxicológica suficiente que determine potenciales riesgos para la salud. Esto queda demostrado en las situaciones que se están presentando en los acueductos de Cipreses y Santa Rosa de Oreamuno, donde a pesar de que se ha realizado mediciones de clorotalonil, no se ha logrado detectar el químico, sin embargo, al realizar mediciones de sus metabolitos se han encontrado concentraciones elevadas de los mismos, demostrando el potencial riesgo de contaminación de genera el clorotalonil en las aguas para consumo humano. Con respecto a las capacidades técnicas para la medición de residuos de plaguicidas el país se encuentra rezagado ya que no existe una relación directa entre las moléculas registradas, sus metabolitos y las técnicas de análisis para su medición en cuerpos de agua superficial y subterránea de los laboratorios del Estado.
Por lo tanto, esta situación se torna riesgosa al no poder incluir a los metabolitos del clorotalonil de manera sistémica y programada en las acciones de vigilancia de agua potable que se realizan en el país. Adicionalmente ante cualquier intervención o plan de saneamiento y mitigación se vuelve desventajoso debido a la imposibilidad de realizar mediciones para implementar indicadores de seguimiento y cumplimiento. Como conclusión final después de una evaluación general de los riesgos asociados al uso del clorotalonil, la ausencia de información en temas de toxicidad y los riesgos de contaminación de aguas superficiales y subterráneas se emite una recomendación de prohibición de la molécula del clorotalonil; con la prohibición se puede iniciar un proceso de saneamiento de las fuentes contaminadas en Cipreses de Oreamuno y en Santa Rosa de Oreamuno, en miras de buscar la rehabilitación y reapertura de las fuentes de agua potable en un futuro además de resguardar tal y como lo indica DIGECA en su informe los bienes constitucionales de la salud humana, la biodiversidad y el ambiente además de evitar futuras contaminaciones.
Ante esta solicitud de prohibición de la molécula se recomienda iniciar un proceso de coordinación con la Dirección de Productos de Interés Sanitario (DRPIS) y los jerarcas del Ministerio de Ambiente y Energía, así como del Ministerio de Agricultura y Ganadería con el fin de redactar un decreto que lleve a una prohibición en el menor tiempo posible (…)” (ver informe rendido bajo juramento y prueba aportada al expediente).
En este sentido, es conveniente aplicar el principio precautorio y generar acciones a nivel del Área Rectora local para que el agua de la Nombre732 no sea consumida por la población hasta no tener como mínimo 3 muestras negativas. Esto es necesario para garantizar que el agua es segura para el consumo humano y no representa un riesgo para la salud pública. Es importante destacar que el Ministerio de Salud, como ente rector en materia de salud pública, debe velar por la salud de la población iniciando desde la prevención. Por lo tanto, se recomienda que se coordine con la ASADA y el AYA para implementar las medidas de prevención y control de la calidad del agua como se han realizado en anterioridad de manera similar con las otras nacientes (…)” (ver informe rendido bajo juramento y prueba aportada al expediente).
Se puede considerar el uso del agua de esta fuente para el funcionamiento de inodoros y otras actividades de limpieza y desinfección intradomiciliaria. Lo anterior, en cumplimiento a lo indicado por el Dr. Albin Badilla Mora en correo electrónico denominado Informe laboratorio análisis muestras ASADA Santa Rosa de Oreamuno nov. 2022, del día de hoy 23 de marzo del 2023, recibido en esta Área Rectora de Salud a las 09:04 horas (…)” (ver informe rendido bajo juramento y prueba aportada al expediente).
Ante la ausencia de información que caracterice e identifique riesgos asociados a la salud por el consumo, ingesta o cualquier otro tipo de contacto de los metabolitos, el agua de esta fuente no podrá ser utilizada para consumo humano, preparación de alimentos y actividades de higiene corporal como parte de un principio precautorio. Se puede considerar el uso del agua de esta fuente para el funcionamiento de inodoros y otras actividades de limpieza y desinfección intradomiciliaria. Lo anterior, en cumplimiento a lo indicado por el Dr. Albin Badilla Mora en correo electrónico denominado Informe laboratorio análisis muestras ASADA Santa Rosa de Oreamuno nov. 2022, del día de hoy 23 de marzo del 2023, recibido en esta Área Rectora de Salud a las 09:04 horas (…)” (ver informe rendido bajo juramento y prueba aportada al expediente).
La desatención e inobservancia de estos aspectos definidos normativa y jurisprudencialmente puede resultar en la vulneración del derecho a un ambiente sano y a la salud pública. En este sentido, el Estado costarricense tiene el poderdeber de procurar por la tutela efectiva y oportuna de estos derechos fundamentales, elevando el nivel de vida de la población 2. El clorotalonil se utiliza principalmente como fungicida en una amplia gama de cultivos, incluyendo hortalizas y frutas. Se han identificado más de 20 metabolitos de este fungicida, incluyendo el 4-hidroxiclorotalonil y el ácido 3-carbamil-2,4,5-triclorobenzoico, que son medianamente móviles y persistentes. 3. El clorotalonil ha sido prohibido en la Unión Europea debido a su potencial carcinogénico y su capacidad para contaminar las aguas subterráneas con metabolitos de su degradación. Aunque el clorotalonil ha sido prohibido, sus metabolitos continúan siendo un problema persistente en el medio ambiente y en el suministro de agua potable.
En Suiza, se ha detectado la presencia de subproductos del clorotalonil en aguas subterráneas y en el agua potable en varios cantones, con niveles que exceden las normas legales establecidas para el agua potable. También se han encontrado metabolitos de clorotalonil en aguas superficiales como el río Rhine y el Lago Zúrich. 4. El clorotalonil es una molécula que, aunque presenta baja potencial de lixiviación, puede ser altamente tóxica para peces e invertebrados acuáticos cuando se aplican durante periodos de lluvia. Además, sus productos de degradación, como el 4-hidroxiclorotalonil, pueden ser tóxicos para mamíferos y aves, incluyendo efectos reproductivos y carcinogénicos. También se ha encontrado residuos de metabolitos del clorotalonil en alimentos, como los arándanos, hasta 76 días después de la aplicación 5. A la luz de la evidencia presentada, se puede concluir que el clorotalonil presenta riesgos significativos para la salud humana y el medio ambiente.
La Agencia de Protección Ambiental de los Estados Unidos ha clasificado el clorotalonil como un posible carcinógeno humano y un posible agente tóxico para la reproducción y el desarrollo, y la exposición a este compuesto puede causar irritación en la piel, los ojos y las vías respiratorias, así como náuseas, dolor de cabeza y mareos. Por su parte, la Autoridad Europea de Seguridad Alimentaria ha identificado problemas críticos además la evaluación del riesgo para los consumidores derivado de la exposición alimentaria no pudo completarse debido a la falta de datos del expediente, lo que sugiere que el uso de este fungicida puede representar un riesgo desconocido para la salud pública. 6. En conclusión, la evaluación realizada por la EFSA indica que la exposición crónica al clorotalonil a través de la dieta puede representar un riesgo para la salud humana, especialmente para los grupos de población más vulnerables.
Además, se ha identificado la presencia de metabolitos altamente contaminantes del Clorotalonil en fuentes de agua destinadas al consumo humano, lo que demuestra el riesgo potencial de contaminación. A pesar de que aún se sabe poco acerca de los efectos que estos compuestos pueden tener en la salud humana, se debe aplicar el principio precautorio en la toma de decisiones y tomar medidas preventivas para minimizar la exposición a estos compuestos. La prohibición del uso del clorotalonil en la Unión Europea es un ejemplo de cómo se está aplicando el principio precautorio para proteger la salud humana y el medio ambiente. 7. En la provincia de Cartago, Costa Rica se cuenta con ocho nacientes destinadas para consumo humano, las cuales están siendo contaminadas debido a la invasión de zonas de protección y de recarga de acuíferos por la actividad agrícola y ganadera. Se ha detectado la presencia de metabolitos de clorotalonil en los acueductos de Cipreses y Santa Rosa del cantón de Oreamuno.
Por lo tanto, es necesario tomar medidas para evitar la contaminación de más fuentes de agua y proteger la salud de la población. 8. Se concluye que existe una preocupación ambiental sobre el clorotalonil, por su toxicidad principalmente para organismos acuáticos tanto a nivel de toxicidad aguda como crónica, y el peligro que representan sus metabolitos por su potencial de contaminar aguas tanto superficiales como subterráneas. Además, éste es un plaguicida de uso común en hortalizas y es preocupante que el país no cuenta con capacidades técnicas para la correcta vigilancia y monitoreo de sus metabolitos en suelos y aguas, igual como ocurre con otros plaguicidas de alto uso en la actualidad. 9. Ante la problemática del uso del plaguicida clorotalonil en fuentes de agua, el MAG propone opciones como la sustitución por otros plaguicidas con el mismo mecanismo de acción, promoción de sistemas de aplicación localizada y el respeto a la zona de protección circundante. 10.
Se evidencia que existe un debilitamiento en la fiscalización, regulación y control del uso del plaguicida clorotalonil en Costa Rica por parte del MAG, lo cual ha generado una problemática ambiental y de salud pública en la zona de aplicación. 11. La opción de sustituir el clorotalonil por biopesticidas o controladores biológicos es una alternativa que no es ampliamente abordada por el MAG en su plan remedial. Sin embargo, esta alternativa debe ser analizada caso por caso, identificando controladores por plaga y por cultivo, así como pruebas de eficacia. 12. Es necesario identificar los cultivos en la zona, las plagas tratadas y confirmar los debidos registros ante el SFE para comprender la problemática suscitada por el clorotalonil. Se deben establecer planes de trabajo que permitan identificar si se están aplicando correctamente las BPA, posibles sustituciones por otros plaguicidas y/o biopesticidas.
Cabe destacar que la sustitución del clorotalonil no garantiza la eliminación del uso de plaguicidas en su totalidad, ya que algunos productos alternativos están siendo reevaluados por sus efectos en la salud y el ambiente. Recomendaciones 1. Se recomienda aumentar la fiscalización y control por parte del Servicio Fitosanitario del Estado, y promover la sustitución del clorotalonil por otros plaguicidas más seguros y la adopción de Buenas Prácticas Agrícolas. De esta manera, se garantizará la protección del medio ambiente y la salud de la población en esta y otras regiones del país donde se utilice este pesticida. 2. Se recomienda el fortalecimiento del Laboratorio Nacional de Aguas para que cuente con los recursos necesarios para la cuantificación de los metabolitos del clorotalonil y que se pueda implementar a nivel nacional un programa de vigilancia y control en agua para consumo humano del clorotalonil y sus metabolitos. 3.
Por lo tanto, además de las recomendaciones emitidas en el oficio DIGECA-563-2022, se recomienda que el SFE realice un levantamiento de los plaguicidas más utilizados en el país y que el análisis de residuos en fuentes de agua, suelos y vegetales se priorice de acuerdo con el volumen de importación actualizado, incluyendo los metabolitos de estos plaguicidas de uso extendido vigente. 4. Es responsabilidad del Estado costarricense regular el uso de sustancias químicas en la agricultura, de manera que se garantice su correcta gestión y uso, sin que esto represente riesgos inaceptables para la salud humana y el medio ambiente. A pesar de que algunas sustancias pueden ser utilizadas de acuerdo con las recomendaciones de uso, es importante considerar los potenciales riesgos que pueden representar los metabolitos y residuos generados, y aplicar el principio precautorio para tomar decisiones informadas y proteger la salud y el bienestar de la población y del ecosistema 5.
Se hace necesario que las instituciones encargadas de la regulación y control de plaguicidas tomen medidas urgentes para prevenir y mitigar los impactos negativos asociados al uso de este plaguicida, lo que implica la implementación de estrategias de fiscalización efectivas, la promoción de prácticas agrícolas sostenibles y la eliminación gradual del clorotalonil de la industria agrícola del país. En definitiva, la protección de la salud humana y del ambiente debe ser el principal objetivo en cualquier estrategia de gestión de plaguicidas. 6. Con el fin de proteger los cuerpos de agua y reducir el riesgo de contaminación por el uso de plaguicidas, se recomienda la promoción de sistemas de aplicación localizada y el respeto a la zona de protección circundante, tal como lo establece el artículo 33 de la Ley N° 7575, Ley Forestal, para las áreas de protección de cuerpos de agua definidas en dicha ley.
Con estas medidas, se promueve la protección de los cuerpos de agua y la salud de la población que depende de ellos. 7. Basado en las alertas de peligrosidad del clorotalonil y la preocupación de que los productos registrados a base de este Ingrediente Activo de Grado Técnico (IAGT) no cuentan con el aval ambiental de DIGECA, se considera que, en pro de salvaguardar el ambiente, resulta fundamental que se cancelen los registros vigentes a base de este plaguicida. Lo anterior en apego a lo estipulado en el numeral ...04 y ...05 del Placa50 y el 16.2 del Placa51 y en el artículo 29 y 30 de la Ley 7664 Ley de Protección Fitosanitaria, referente a suspensiones y cancelaciones de registro. 8. En concordancia con las recomendaciones expuestas, así como de los riesgos analizados, se recomienda la prohibición del uso del clorotalonil en Costa Rica, en línea con las medidas adoptadas por la Unión Europea.
Se deben implementar medidas de seguridad y alternativas para la agricultura que minimicen la exposición de los trabajadores y de los consumidores, así como velar por la protección de las fuentes de agua, el medio ambiente y la salud de la población (…)” (ver prueba enumerada con los folios del 00159 al 00175 y 00253 al 00285 aportada por el Ministerio de Salud en su informe del 26 de abril de 2023 y aportada nuevamente por el recurrente el 31 de mayo de 2023).
C.- Sobre el ICAA:
Prohibición de clorotalonil (responsable Ministerio de Agricultura y Ganadería; Concejo de Gobierno y la Asamblea Legislativa) 6. Cambio en prácticas agrícolas (responsable Ministerio de Agricultura y Ganadería) 7. Caracterización de los efectos en la salud de las personas por la presencial de metabolitos del clorotalonil (responsable Ministerio de Salud; Ministerio de Agricultura y Ganadería; Laboratorio Nacional de Aguas del AyA) 8. Cambios en usos de suelo (responsable Ministerio de Agricultura y Ganadería y Gobiernos Locales) 9. No uso de fuentes de agua para consumo humano (responsable Nombre733 Ministerio de Salud y la Dirección de la UEN Asadas) 10. Distribución de agua por cisterna (responsable Asadas; Dirección UEN Asadas) 11. Remediación de las fuentes de agua (responsables MINAE; gobiernos locales; Ministerio de Salud; Laboratorio Nacional de Aguas) 12. Reapertura y cuido de las fuentes de agua (Ministerio de Salud y Laboratorio Nacional de Aguas del AyA)” (ver informen rendido bajo juramento).
D.- En cuanto al MINAE (SINAC) y al MAG:
Que el SFE como autoridad competente en la gestión del uso de agroquímicos desarrolle un plan de acción para la prohibición del Clorotalonil, esto busca de una remediación del problema de contaminación de aguas con este fungicida, siguiendo los pasos de la Unión Europea donde no se ha renovado su registro debido a que los usos propuestos han evidenciado riesgos para la salud humana y el ambiente. Que mediante, oficio DIGECA-134-2023 suscrito por la Licda. Shirley Soto Montero, Directora de la Dirección de Gestión de Calidad Ambiental da respuesta al Ministerio de Salud respecto a que se solicita equipo interinstitucional para realizar aportes sobre la contaminación con CLOROTALONIL en las fuentes de agua, con la finalidad de elaborar un informe, donde se solicita, que el SFE como autoridad competente en la gestión del uso de agroquímicos desarrolle un plan de acción para velar por el uso seguro de Clorotalonil en la zona afectada en busca de una remediación del problema de contaminación de aguas con este fungicida, el cual cuente con las acciones específicas, los respectivos indicadores que demuestren que se reduce la afectación de la población y los recursos necesarios para su ejecución.
En caso contrario, proceder con el proceso de prohibición del uso de los productos que contienen Clorotalonil, siguiendo los pasos de la Unión Europea donde no se ha renovado su registro debido a que los usos propuestos han evidenciado riesgos para la salud (…)” (ver informen rendido bajo juramento y prueba aportada al expediente digital).
A continuación, se indican algunas de las actividades que se han realizado, y se tienen programadas, para atender esta situación: En respuesta a la Orden Sanitaria MS-DRRSCE-DARSO-OS-0098-2022, se elaboró el “Plan de manejo remedial para implementar en fuentes de agua de la ASADA Cipreses de Oreamuno” que en sus 26 páginas incluye consideraciones importantes donde se menciona que es de suma importancia promover la rotación de moléculas para evitar su acumulación en suelos, aguas, cultivos y evitar que pierdan efectividad en el control de plagas y enfermedades, de manera que la descontaminación también sea sostenible en el tiempo, pero siendo conscientes de los procesos que actualmente se llevan a cabo en el país para el registro de nuevas moléculas, ampliaciones de uso y homologaciones, se propone que los jerarcas del MAG, Ministerio de Salud y MINAE, principalmente, elaboren un decreto amparado en el Artículo 29 de la Ley 7664, para regular la venta y/o uso de clorotalonil a nivel país.
En este decreto se sugiere establecer la venta restringida, únicamente autorizada bajo receta profesional, de manera que solamente las empresas que cuenten con regentes agrícolas puedan comercializar el producto, para lo cual se requiere la responsabilidad correspondiente de los regentes y la supervisión del Colegio de Ingenieros Agrónomos de Costa Rica. Esta acción sería una medida aplicada en amparo al principio precautorio, similar al que toma el Ministerio de Salud para emitir la orden sanitaria para el cierre de las ASADAS, y al principio pro natura, pero respaldado ante la evidencia técnica de los hallazgos en las fuentes del metabolito 1,3-dicarbamoil-2,4,5,6tetraclorobenceno (derivado del fungicida clorotalonil). Es el SFE el Órgano que tiene el respaldo legal para prohibir a los productores el uso de agroquímicos o moléculas específicas si estas cuentan con los registros de uso correspondientes en el país y para el cultivo o actividad que se desarrolla, así como tampoco se cuenta con respaldo legal para obligar a los productores a acatar las recomendaciones que el personal técnico sugiera en cada caso o participar en las capacitaciones que eventualmente se planteen o programen, por lo que las medidas no pueden ser basadas en solo algunos criterios y soluciones restrictivas, entonces este plan propone múltiples medidas para encontrar soluciones que, de manera integral, reduzcan efectivamente el uso de las moléculas identificadas, pero que al mismo tiempo brinde el debido proceso de búsqueda y aprobación de medidas alternativas y sustitutivas; asegurando un equilibrio entre todos los factores socioeconómicos, de salud y ecológicos.
La Unidad Regional Central Oriental del SFE, no se cuenta con la posibilidad de prohibir o restringir el uso o comercialización de plaguicidas específicos a nivel regional, sino que los jerarcas de nuestras instituciones, en conjunto con los jerarcas del Ministerio de Salud y del Ministerio de Ambiente y Energía, y en ocasiones, con los jerarcas del Ministerio Trabajo y Seguridad Social deben trabajar en conjunto para elaborar el correspondiente Decreto Ejecutivo, que una vez aprobado, firmado y publicado nos puede ordenar algún uso de tipo: Prohibición total, Prohibición total excepto formulaciones específicas, Prohibición de presentaciones específicas, Prohibición de usos específicos, Restricción total bajo receta profesional, Restricción de formulaciones específicas, Restricción de usos específicos, Otras restricciones (No venta libre, tipo de aplicación, etc.) . Se recuerda que en primera instancia se enfocó este problema con un nombre específico, a saber: “Plan de manejo remedial para implementar en fuentes de agua de la ASADA Cipreses de Oreamuno”, pero el manejo se extendió a todas las Nombre733 aledañas, se detallan los actores que deben estar involucrados en la implementación del plan, la necesidad de estudios hidrogeológicos actualizados que consideren detalles importantes sobre el tránsito y comportamiento de los posibles contaminantes (agroquímicos principalmente) en el agua, el programa de regulación, el programa de retiro de uso del clorotalonil, el requerimiento de nuevas moléculas y nuevas tecnologías, y la necesidad de un plan de capacitación para brindar herramientas a los productores.
La reducción de la frecuencia de uso del clorotalonil detallado en el “Plan de manejo remedial para implementar en fuentes de agua de la ASADA Cipreses de Oreamuno” indica los productos comerciales registrados que poseen al clorotalonil dentro de sus ingredientes (se encontraron al menos 53 productos comerciales de 29 empresas registrantes diferentes), y la lista de cultivos (ajo, apio, ayote, brócoli, café, cebolla, chile dulce, cítricos, coliflor, frijol, lechuga, melón, remolacha, repollo, tomate, zanahoria, papa, pepino, zucchini, banano, plátano, sandía, puerro, vainica, arroz, zapallo, papaya, otros) aprobados en etiqueta en Costa Rica para estos productos comerciales (…)” (ver informen rendido bajo juramento y prueba aportada al expediente digital).
IV.Antecedente de interés. De previo, es preciso traer a colación lo dispuesto por la Sala en la sentencia No. 2022-026065 de las 9:45 horas de 4 de noviembre de 2022, en la que se denunció la contaminación del agua en las nacientes de Nombre424 y Nombre423 , de la ASADA de Cipreses de Oreamuno de Cartago. Así, en la sentencia de cita, este Tribunal dispuso lo siguiente:
“II.-OBJETO DEL RECURSO. Los recurrentes manifiestan que las nacientes de Nombre424 y Nombre423 , de la ASADA de Cipreses de Oreamuno de Cartago, presentaron resultados positivos de plaguicidas según fue reconocido por el Instituto Costarricense de Acueductos y Alcantarillados, de acuerdo a un estudio del Instituto Regional de Estudios en Sustancias Tóxicas (IRET) de la Universidad Nacional. Agregan que el informe UNA-LAREP-OFIC-060-2021-S20-13-05-2021 del 17 de diciembre de 2021, del IRET, se menciona la presencia de productos de la degradación del plaguicida clorotalonil, así como trazas de 9 plaguicidas varios en el agua de las referidas nacientes. Afirman que la situación es de conocimiento del Ministerio de Salud, según consta en el informe técnico MS-DRRSCEDARSO-IT-00312-2021. Apunta que los resultados positivos de contaminación fueron presentados desde el 2021 al Ministerio de Salud y a la ASADA de Cipreses de Oreamuno de Cartago, pero no se tomaron las medidas correspondientes en protección a la salud pública ni ambiental.
Precisan que desde el 1° de abril de 2022, se presentaron las denuncias por escrito al Área Rectora de Salud de Oreamuno del Ministerio de Salud y a la Gerencia General del Instituto Costarricense de Acueductos y Alcantarillados, donde se solicitó que se dispusiera agua libre de contaminantes agrotóxicos en cisternas amparados en el principio precautorio, se realizaran los análisis para mantener el monitoreo constante de los productos de degradación del clorotalonil de forma periódica, se les entregara los resultados del monitoreo de plaguicidas e hicieran públicos y el cuido de las áreas de protección de las tomas de agua de la comunidad. Señalan que, en respuesta de las denuncias, el Laboratorio Nacional de Aguas del ICAA hizo un análisis de agua para unos plaguicidas, pero omitió referirse sobre la presencia de los subprocesos específicos de clorotalonil y no analizaron ni reportaron los compuestos “3- dicarbomoil-2,4,5, tetraclorobenceno y el 4-hidroxiclorotalonil”, a pesar de ello aseveraron públicamente que el agua es potable. Enfatizan que el IRET de la Universidad Nacional, el Ministerio de Salud y el mismo Instituto Costarricense de Acueductos y Alcantarillados han reconocido la contaminación del agua. (…)
En el sub lite, los recurrentes manifiestan que las nacientes de Nombre424 y Nombre423 , de la ASADA de Cipreses de Oreamuno de Cartago, presentaron resultados positivos de plaguicidas según fue reconocido por el Instituto Costarricense de Acueductos y Alcantarillados, de acuerdo a un estudio del Instituto Regional de Estudios en Sustancias Tóxicas (IRET) de la Universidad Nacional. Agregan que el informe UNA-LAREP-OFIC060-2021-S20-13-05-2021 del 17 de diciembre de 2021, del IRET, se menciona la presencia de productos de la degradación del plaguicida clorotalonil, así como trazas de 9 plaguicidas varios en el agua de las referidas nacientes. Afirman que la situación es de conocimiento del Ministerio de Salud, según consta en el informe técnico MS-DRRSCE-DARSO-IT-00312-2021. Apunta que los resultados positivos de contaminación fueron presentados desde el 2021 al Ministerio de Salud y a la ASADA de Cipreses de Oreamuno de Cartago, pero no se tomaron las medidas correspondientes en protección a la salud pública ni ambiental.
Precisan que desde el 1° de abril de 2022, se presentaron las denuncias por escrito al Área Rectora de Salud de Oreamuno del Ministerio de Salud y a la Gerencia General del Instituto Costarricense de Acueductos y Alcantarillados, donde se solicitó que se dispusiera agua libre de contaminantes agrotóxicos en cisternas amparados en el principio precautorio, se realizaran los análisis para mantener el monitoreo constante de los productos de degradación del clorotalonil de forma periódica, se les entregara los resultados del monitoreo de plaguicidas e hicieran públicos y el cuido de las áreas de protección de las tomas de agua de la comunidad. Señalan que, en respuesta de las denuncias, el Laboratorio Nacional de Aguas del ICAA hizo un análisis de agua para unos plaguicidas, pero omitió referirse sobre la presencia de los subprocesos específicos de clorotalonil y no analizaron ni reportaron los compuestos “3-dicarbomoil-2,4,5, tetraclorobenceno y el 4- hidroxiclorotalonil”, a pesar de ello aseveraron públicamente que el agua es potable. Enfatizan que el IRET de la Universidad Nacional, el Ministerio de Salud y el mismo Instituto Costarricense de Acueductos y Alcantarillados han reconocido la contaminación del agua. (…)
Al respecto, se verifica que las autoridades recurridas, al menos desde el año anterior, han efectuado esfuerzos para constatar o descartar la presencia de plaguicidas en las Nacientes de Nombre736 y de Nombre423 (sistemas administrados por la ASADA de Cipreses de Oreamuno). En tal sentido, se han llevado a cabo distintos estudios respecto al plaguicida clorotalonil, ante la sospecha de posibles residuos en las nacientes aludidas. Así, en el informe nro. MS-DPRSA-USA-679- 2022 de 28 de abril de 2022, la Unidad de Salud Ambiental del Ministerio de Salud consignó: “RESULTADOS. Según se observa en la Tabla 1 no se detectó el plaguicida clorotalonil en las muestras recolectadas en la ASADA Cipreses, tanto para el Sistema Nombre736 como para el Sistema Nombre423 (…)
En estos análisis puntuales realizados a ambos sistemas en sus nacientes no se detectó la presencia de plaguicidas, tampoco se detectó clorotalonil”. Sin embargo, desde diciembre del año anterior, el Laboratorio de Análisis de Residuos de Plaguicidas de la UNA efectuó un estudio, en el que detectó productos de degradación del clorotalonil, concretamente: “1,3 dicarbamoil-2, 4,5,6- tetraclorobenceno y el 4-hidroxiclorotalonil”. Luego, durante la tramitación de este proceso de constitucionalidad, concretamente el 26 de septiembre anterior, se efectuó otro muestreo en las nacientes de marras, cuyo informe de resultados señaló: “se procedió a realizar la inyección de las muestras recolectadas en las dos nacientes de la comunidad de Cipreses (Nombre736 y Nombre423 ), así como cinco patrones de 250 μg/L 500 μg/L, 750 μg/L, 1000 μg/L y 2000 μg/L. A continuación, se detallan los resultados obtenidos: Para la naciente Nombre736 se obtuvo una concentración aproximada de 1,3- dicarbamoyl-2,4,5,6-tetraclorobenceno de 19,36 μg/L en la muestra recolectada, mientras que, para la naciente Nombre423 , la concentración aproximada fue de 1,73 μg/L en la muestra recolectada.
Para las determinaciones en ambos muestreos se utilizó el patrón facilitado por el Sr. Clemens Ruepert. Cabe destacar que el patrón usado no es certificado con trazabilidad bajo los términos de Acreditación en la norma internacional INTE-ISO/IEC 17025:2017, (ni se ha encontrado un patrón que cumpla con esto). Adicionalmente, el método utilizado para esta determinación no se encuentra acreditado, y de momento aún no se posee la validación correspondiente, generando poca certeza en la concentración exacta del compuesto. Sin embargo, las concentraciones encontradas son superiores al valor máximo admisible del reglamento DE 38924-S.”. De este modo, si bien los recurridos señalan que los estudios y resultados no se encuentran acreditados en los términos del ordinal 10 del Reglamento para la Calidad de Agua Potable, no menos cierto es que la concentración de metabolitos reportada (19,36 μg/L y 1,73 μg/L) es claro indicio de un problema de contaminación, pues los valores sobrepasan de manera importante el máximo que admite la normativa ordinaria (el cual es 0.1 μg/L).
Incluso, véase que la orden sanitaria nro. MS-DRRSCE-DARSO-OS-0087-2022 dispuso que tales fuentes de agua no podrían ser utilizadas para consumo, preparación de alimentos ni actividades de higiene corporal. Ahora, si bien desde el primer estudio efectuado a finales del año anterior los recurridos conocían sobre la presencia de los metabolitos en las nacientes referidas, no fue sino hasta en el segundo muestreo (efectuado durante el trámite de este recurso) que se tomaron medidas en concreto, sin que de ello se verifique una solución definitiva para la situación de marras. En tal sentido, si bien mediante las órdenes sanitarias emitidas el 20 de octubre del año en curso se dispuso la clausura inmediata de las fuentes de Nombre736 y Nombre423 de la ASADA de Cipreses, la comunicación a la comunidad de Cipreses de Oreamuno de la situación, el suministro de agua a esta comunidad a través de camiones cisterna y la elaboración de un plan correctivo, no menos cierto es que tales acciones constituyen medidas provisionales, mientras que la situación objeto del sub iudice amerita una solución integral y definitiva dentro de un plazo razonable. (…)
Por tanto: Se declara con lugar el recurso. Se ordena a Eric Alonso Bogantes Cabezas y María José Lafuente González, por su orden, gerente general del Instituto Costarricense de Acueductos y Alcantarillados y directora a.i. del Área Rectora de Salud de Oreamuno, o a quienes respectivamente ocupen tales cargos, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus respectivas competencias para que, en el plazo máximo de TRES MESES, contado a partir de la notificación de esta sentencia, se ejecuten las coordinaciones y acciones pertinentes, en el marco de un plan conjunto, para 1) solucionar de manera integral y definitiva la situación de contaminación por metabolitos de clorotalonil en las nacientes de Nombre736 y Nombre423 de la ASADA de Cipreses de Oreamuno; y 2) investigar si el problema de contaminación en las nacientes supracitadas ha perjudicado a otras comunidades de la zona. En el ínterin, las autoridades supracitadas deberán garantizar el suministro de agua potable a las comunidades afectadas mediante camiones cisterna u otra alternativa…”.
V.Sobre la protección del ambiente y el principio de coordinación administrativa. Mediante la Sentencia No. 2012-8892 de las 16:03 horas del 27 de junio de 2012, esta Sala dispuso lo siguiente:
“(…) VI. Sobre el principio de coordinación interadministrativa. Uno de los principios rectores de la organización administrativa lo constituye la coordinación que debe mediar entre todos los entes y órganos públicos al ejercer sus competencias y prestar los servicios que el ordenamiento jurídico les ha asignado. La coordinación, en cuanto asegura la eficiencia y eficacia administrativas, es un principio constitucional virtual o implícito que permea el entero ordenamiento jurídico administrativo y obliga a todos los entes públicos. Esta puede ser interorgánica –entre los diversos órganos que conforman un ente público no sujetos a una relación de jerarquía– o intersubjetiva, esto es, entre los entes públicos, cada uno con personalidad jurídica, presupuesto propio, autonomía y competencias específicas. La autonomía administrativa o de otro grado de cuya titularidad gozan los entes públicos los obliga a coordinar sus acciones, puesto que no pueden estar sometidos recíprocamente a relaciones de jerarquía por su naturaleza interorgánica.
La coordinación administrativa tiene por propósito evitar las duplicidades y omisiones en el ejercicio de las funciones administrativas de cada ente público, esto es, que sean desempeñadas de forma racional y ordenada; y se logra a través del establecimiento de niveles o canales fluidos y permanentes de información entre los entes públicos, todo lo cual se puede lograr a través de reuniones, informes o la creación de instancias formales de coordinación.
VII.Sobre la coordinación interinstitucional en materia ambiental. Específicamente en materia de tutela ambiental, la sentencia número 2008-004790 subrayó el deber de coordinación entre las instituciones relacionadas con el tema y la imposibilidad de hacer caso omiso a las advertencias sobre el peligro de contaminación que emite una institución facultada por ley para proteger el recurso hídrico:
“III.- La coordinación entre las dependencias públicas debe garantizar la protección del ambiente. En diversas oportunidades, la jurisprudencia constitucional ha indicado que la protección del ambiente es una tarea que corresponde a todos por igual, es decir, que existe una obligación para el Estado –como un todo- de tomar las medidas necesarias para proteger el medio, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan el peligro la salud de los administrados. En esta tarea, por institución pública, debe entenderse comprendida tanto la Administración Central –Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia, como por ejemplo, la Dirección General de Vida Silvestre, la Dirección Forestal, y la Secretaría Técnica Nacional Ambiental (SETENA); así como también las instituciones descentralizadas, caso del Instituto Nacional de Vivienda y Urbanismo, el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, el Instituto Costarricense de Turismo o el Instituto Costarricense de Acueductos y Alcantarillados; tarea en la que por supuesto, tienen gran responsabilidad las municipalidades, en lo que respecta a su jurisdicción territorial.
Es por ello, que podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa, lo cual no es cierto, por cuanto a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, es que se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala con anterioridad –y en forma bastante clara- se refirió al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes -lo cual, obviamente se debe hacer extensivo a la relación que en esta importante función realizan las instituciones de la Administración Central y las descentralizadas-, para lo cual se remite a lo indicado en aquella ocasión (sentencia número 5445-99, de las catorce horas treinta minutos del catorce de julio de mil novecientos noventa y nueve):
"De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector).” Por otro lado, las omisiones al deber de protección del ambiente y de cumplimiento de la normativa ambiental son de relevancia constitucional, por cuanto a consecuencia de la inercia de la Administración en esta materia, se puede producir un daño al ambiente y a los recursos naturales, a veces, de similares o mayores consecuencias, que de las derivadas de las actuaciones de la Administración; como lo es la autorización de planes reguladores, o construcciones sin la aprobación del estudio de impacto ambiental por parte Secretaría Técnica Nacional Ambiental, o la falta de control y fiscalización en la ejecución de los planes de manejo de las áreas protegidas por parte de la Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía, o el permitir el funcionamiento de empresas sin los permisos de salud en lo que respecta al tratamiento de aguas negras o residuales (Acueductos y Alcantarillados y Ministerio de Salud), o no verificar los controles sónicos en bares, karaokes y discoteques (municipalidades y Ministerio de Salud), entre otros (ver al respecto sentencia número 2006-005159 de las trece horas cuatro minutos del siete de abril del dos mil seis).” En otras palabras, interesan la cooperación técnica que puedan brindarse los distintos entes, los elementos técnicos que éstos puedan aportar y el respeto a las competencias de cada uno; a fin de garantizar sin lugar a dudas que la incidencia de los proyectos que se evalúen no sea negativa, y así garantizar la gestión sostenible de los recursos hídricos y el pleno derecho a un ambiente sano y ecológicamente equilibrado, tal como lo consagra la norma constitucional.
Así, el principio precautorio -que pretende evitar o suspender cualquier actividad que pueda incidir negativamente en dicha gestión- obliga a la Administración, en primer lugar, a emplazar a los afectados e interesados, y a las instituciones que puedan verse involucradas. Ello para que puedan hacer las alegaciones correspondientes y presentar los criterios técnicos correspondientes, y asegurar una efectiva participación de los órganos competentes en la materia en aras de proteger y preservar el ambiente y el recurso hídrico. Y obliga, en segundo lugar, a tomar en consideración las advertencias que haga una institución facultada por ley para proteger el recurso hídrico sobre el peligro de contaminación".
VI.Atinente al derecho a la salud y a disfrutar de un ambiente sano y ecológicamente equilibrado. La salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Carta Magna), así como a través de la normativa internacional. En este sentido, este Tribunal Constitucional, en el Voto No. 3705-93 de las 15:00 horas del 30 de julio de 1993, indicó lo siguiente:
“(...) La calidad ambiental es un parámetro de esa calidad de vida; otros parámetros no menos importantes son salud, alimentación, trabajo, vivienda, educación, etc., pero más importante que ello es entender que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene en deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras, lo cuál no es tan novedoso, porque no es más que la traducción a esta materia del principio de la "lesión", ya consolidado en el derecho común, en virtud del cuál el legítimo ejercicio de un derecho tiene dos límites esenciales: Por un lado, los iguales derechos de los demás y, por el otro, el ejercicio racional y el disfrute útil del derecho mismo (...)".
Asimismo, existe una obligación del Estado de proteger el ambiente que se encuentra contemplada, expresamente, en el párrafo segundo, del artículo 50 de la Constitución Política, que dispone en lo conducente:
"(...) Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado (...)".
En relación con lo expuesto, esta Sala, mediante la Sentencia No. 180-98 de las 16:24 horas del 13 de enero de 1998, dispuso lo siguiente:
"(...) el Estado no solo tiene la responsabilidad ineludible de velar para que la salud de cada una de las personas que componen la comunidad nacional, no sufra daños por parte de terceros, en relación a estos derechos, sino que, además, debe asumir la responsabilidad de lograr las condiciones sociales propicias a fin de que cada persona pueda disfrutar de su salud, entendido tal derecho, como una situación de bienestar físico, psíquico(o mental) y social (…)".
De otra parte, la normativa infraconstitucional desarrolla este derecho y, en este sentido, la Ley General de Salud autoriza al Ministerio de Salud para tomar las medidas sanitarias correspondientes e imponer las sanciones con el fin de proteger el medio ambiente y el derecho a la salud de las personas. Asimismo, cabe señalar que este Tribunal, como garante de los derechos fundamentales, se erige como un contralor del cumplimiento de las obligaciones que derivan de lo dispuesto en los artículos 21 y 50 constitucionales, que constriñen al Estado no sólo a reconocer los derechos señalados, sino, además, a utilizar los medios materiales y, jurídicamente, legítimos para garantizarlos.
VII.Sobre el derecho de acceso al agua potable. En reiteradas resoluciones esta Sala ha reconocido un derecho fundamental al agua potable; sobre éste, se pronunció en la resolución No. 2006-005606, de las 15:21 horas del 26 de abril de 2006, de la siguiente manera:
«VII.-El acceso al agua potable como derecho humano. Adicionalmente a lo señalado, y talvez el aspecto más relevante en este tema, lo constituye la naturaleza y función del agua para la vida humana. No es necesario detallar aquí una explicación sobre la realidad evidente y notoria de que sin agua no puede haber vida, ni calidad de vida, y que por lo tanto, con ley o sin ley de nacionalización, por su propia esencia, este tema, no es ni puede ser un tema territorial o local. La propia Sala en su jurisprudencia constitucional ha dicho que el acceso al agua potable es un derecho humano fundamental, en cuanto se configura como un integrante del contenido del derecho a la salud y a la vida. (SALA CONSTITUCIONAL, sentencias números 534-96, 2728-91, 3891-93, 1108-96, 2002-06157 2002-10776; 2004-1923). Esta misma línea se ha mantenido en las sentencias 2003-04654 y 2004-07779, que en lo que interesa señalan:
“V.- La Sala reconoce, como parte del Derecho de la Constitución, un derecho fundamental al agua potable, derivado de los derechos fundamentales a la salud, la vida, al medio ambiente, a la alimentación y la vivienda digna, entre otros, tal como ha sido reconocido también en instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica: así, figura explícitamente en la Convención sobre la Eliminación de todas las formas de discriminación contra la mujer (art. 14) y la Convención sobre los Derechos del Niño (art. 24); además, se enuncia en la Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2), y se declara en otros numerosos del Derecho Internacional Humanitario. En nuestro Sistema Interamericano de Derechos Humanos, el país se encuentra particularmente obligado en esta materia por lo dispuesto en el artículo 11.1 del Protocolo Adicional a la Convención Americana sobre Derechos en Materia de Derechos Económicos, Sociales y Culturales (“Protocolo de San Salvador” de 1988), el cual dispone que: “Artículo 11.
Derecho a un medio ambiente sano 1.-Toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos”. La carencia de recursos no justifica el incumplimiento de los cometidos de las administraciones públicas en la prestación de este servicio básico. (SALA CONSTITUCIONAL, resoluciones 2003-04654 y 2004-007779).
VIII.Sobre el caso concreto. En el sub examine, el recurrente estima vulnerados sus derechos fundamentales, toda vez que, que es vecino de Cipreses de Cartago, comunidad que recibe el servicio de agua potable por medio de la ASADA de Santa Rosa de Oreamuno de Cartago. Reclama que, desde el año 2021, el acueducto de esa asociación cuenta con problemas de contaminación con una sustancia denominada "clorotalonil", a partir de lo cual el Ministerio de Salud giró órdenes sanitarias y de clausura de cinco nacientes de agua, propiamente las siguientes nacientes: Piedra, Nombre730 , Birris, Agua Fría y Manuel Granados. Menciona que, además, los problemas de contaminación de cita fueron confirmados a través de un estudio realizado conjuntamente por IRET-UNA y el Laboratorio Nacional de Agua del Instituto Costarricense de Acueductos y Alcantarillados. No obstante, aqueja que los problemas de contaminación persisten.
Sobre el particular, se tuvo como un hecho incontrovertido que el amparado es vecino de Cipreses de Cartago, comunidad que recibe el servicio de agua potable por medio de la ASADA de Santa Rosa de Oreamuno de Cartago. Ahora bien, consta que la ASADA de Santa Rosa de Oreamuno, está circunscrita en un territorio agrícola y posee la administración de las nacientes Piedra, Nombre731 , Nombre730 , Birrís, Nombre732 , Agua Fría y Manuel Granados. En este sentido, se acreditó que es de conocimiento pleno de cada una de las instituciones recurridas que existe contaminación del agua en las nacientes que dotan de agua a la ASADA de Santa Rosa de Oreamuno y debido a esto, desde el 17 de octubre de 2022,se tomó el acuerdo de clausurar las fuentes de agua de la ASADA de Cipreses y de Santa Rosa, dado que, en una toma de muestras realizada los días 17 y 18 de octubre de 2022, se determinó la presencia de los metabolitos del fungicida Clorotalonil en cinco de las siete nacientes que abastecen dicho acueducto, dando una alerta al Ministerio de Salud.
En virtud de esta circunstancia, el 2 de noviembre de 2022, en conjunto con funcionarios del ICCA, en seguimiento al caso de contaminación por metabolitos del plaguicida Clorotalonil en acueductos administrados por la de Oreamuno, se concluyó que se haría un “remuestreo” de la ASADA Santa Rosa. Nótese que, el 3 de noviembre de 2022, al determinarse la contaminación de agua con plaguicidas, mediante oficio MS-DPRSA-0668-2022, funcionarios del Ministerio de Salud solicitaron la coordinación entre la Dirección Regional Rectora de Salud Central Este y el Área Rectora de Salud de Oreamuno, a fin de que se emitiera una orden sanitaria para que las nacientes contaminadas que utiliza la ASADA de Santa Rosa no se usen para consumo humano e indicaron que: “(…) el clorotalonil es un fungicida aprobado para uso en el país registrado bajo una gran variedad de nombres y usado en la agricultura de variedad de productos.
Una vez la sustancia química entra en contacto con el ambiente, aire, suelo y / o microorganismos sufre una serie de modificaciones producto del metabolismo de organismos vivos o procesos químicos que lo descomponen en otras moléculas conocidas como metabolitos o productos de degradación, para el caso del Clorotalonil existe documentado más de 7 moléculas distintas de degradación. Para el caso específico de los metabolitos 1,3-dicarbamoil-2,4,5,6 tetraclorobenceno y el 4- hidroxiclorotalonil existe poca documentación disponible, en especial sobre la afectación para la salud humana, existiendo un poco más de información sobre riesgos ambientales y ecotóxicos para el 4- hidroxiclorotalonil. A nivel internacional en la Unión Europea se decidió en el 2019 prohibir el uso del plaguicida clorotalonil porque se identificó un problema crítico en relación con la contaminación de las aguas subterráneas por los metabolitos del plaguicida.
La Autoridad Europea no pudo descartar un posible problema de genotoxicidad de los residuos a los que se verían expuestos los consumidores y detectó un alto riesgo para los anfibios y los peces en todos los usos evaluados. Asimismo, el clorotalonil, como tal, está clasificado como carcinógeno. Por otro lado, la Agencia de Protección Ambiental de los Estados Unidos (EPA) ha determinado que los productos del clorotalonil no suponen riesgos para los seres humanos o el medio ambiente mientras que se sigan los usos autorizados y las indicaciones de la etiqueta del producto. Sin embargo, ha declarado que existe un faltante de estudios para determinar riesgos por sus metabolitos. En conclusión, desde el punto de vista de salud humana existe una deficiencia en estudios científicos que caractericen e identifiquen riesgos asociados a la salud por el consumo, ingesta o cualquier otro tipo de contacto del metabolito 1,3-dicarbamoil-2,4,5,6 tetraclorobenceno, sin embargo, sí existen estudios que caracterizan al clorotalonil como altamente tóxico para la vida acuática y moderadamente tóxico en aves y lombrices.
Por lo que se debe de considerar con extrema precaución cualquier indicio de contaminación con este plaguicida o metabolito y tomar las medidas necesarias para evitar su ingesta o contacto en vista de la poca evidencia científica que existe referente a la salud humana y apoyarse en los estudios que confirman la ecotoxicidad que presenta, así como el riesgo para la salud ambiental (…)”.
Luego, el 4 de noviembre de 2022, mediante el oficio MS-DM-9862-2022, la entonces Ministra de Salud solicitó la coordinación urgente entre la Dirección Regional Rectora de Salud Central Este y el Área Rectora de Salud de Oreamuno a fin de tomar las medidas descritas en el oficio MS-DPRSA-0668 y se emita un plan de acción con acciones a corto, mediano y largo plazo al ICAA para solucionar la situación de contaminación. Así, en fechas 8 y 9 de noviembre de 2022, se efectuó un remuestreo de la ASADA Santa Rosa.
Asimismo, consta que el Área Rectora de Salud recurrida giró y notificó nueve órdenes sanitarias; en los siguientes términos: la MS-DRRSCE-DARSO-OS-0100-2022 al Presidente de la ASADA de Santa Rosa, con el fin de: 1) informar a la comunidad por la mayor cantidad de medios de comunicación posible que las fuentes de agua potable que utiliza esa ASADA de las nacientes de Piedra, Nombre730 , Birris, Agua Fría y Manuel Granados no pueden ser utilizadas para consumo humano, preparación de alimentos o actividades de higiene y, 2) comunicar a la comunidad de Santa Rosa sobre la situación presentada en la ASADA con los metabolitos del plaguicida Clorotalonil; las MS-DRRSCE-DARSO-OS-0102-2022, MS-DRRSCE-DARSO-OS-0105-2022 y MS-DRRSCE-DARSO-OS-0108-2022, todas al Presidente del Instituto Costarricense de Acueductos y Alcantarillados, con el fin de:
Además, se comprobó que, desde el 14 de diciembre de 2022, el Ministerio de Salud solicitó la prohibición de la molécula clorotalonil y el inicio de un proceso de coordinación al efecto entre la Dirección de Productos de Interés Sanitario (DRPIS) y los jerarcas del Ministerio de Ambiente y Energía, así como del Ministerio de Agricultura y Ganadería, en donde se expuso: “(…) Según estimaciones de PNUD en Costa Rica existe un elevado consumo de plaguicidas sumado a un debilitamiento de los servicios de extensión agrícola y de investigaciones en el Ministerio de Agricultura y Ganadería que conlleva a una generación de riesgos por contaminación de aguas superficiales y subterráneas que pueden comprometer fuentes de agua para consumo humano, hechos que han sucedido en Limón y en la Zona Norte con implicaciones económicas y sociales muy altas, ahora a estos hechos de contaminación se suman las comunidades de Cipreses y Santa Rosa de Oreamuno.
El Clorotalonil es una molécula con capacidad para producir metabolitos una vez ingresa al ambiente, con un alto potencial de contaminación y según la EFSA aun cuando se utilice de manera correcta este plaguicida tendrá la capacidad de contaminar fuentes de agua y que sus metabolitos no cuentan con información toxicológica suficiente que determine potenciales riesgos para la salud. Esto queda demostrado en las situaciones que se están presentando en los acueductos de Cipreses y Santa Rosa de Oreamuno, donde a pesar de que se ha realizado mediciones de clorotalonil, no se ha logrado detectar el químico, sin embargo, al realizar mediciones de sus metabolitos se han encontrado concentraciones elevadas de los mismos, demostrando el potencial riesgo de contaminación de genera el clorotalonil en las aguas para consumo humano. Con respecto a las capacidades técnicas para la medición de residuos de plaguicidas el país se encuentra rezagado ya que no existe una relación directa entre las moléculas registradas, sus metabolitos y las técnicas de análisis para su medición en cuerpos de agua superficial y subterránea de los laboratorios del Estado.
Por lo tanto, esta situación se torna riesgosa al no poder incluir a los metabolitos del clorotalonil de manera sistémica y programada en las acciones de vigilancia de agua potable que se realizan en el país. Adicionalmente ante cualquier intervención o plan de saneamiento y mitigación se vuelve desventajoso debido a la imposibilidad de realizar mediciones para implementar indicadores de seguimiento y cumplimiento. Como conclusión final después de una evaluación general de los riesgos asociados al uso del clorotalonil, la ausencia de información en temas de toxicidad y los riesgos de contaminación de aguas superficiales y subterráneas se emite una recomendación de prohibición de la molécula del clorotalonil; con la prohibición se puede iniciar un proceso de saneamiento de las fuentes contaminadas en Cipreses de Oreamuno y en Santa Rosa de Oreamuno, en miras de buscar la rehabilitación y reapertura de las fuentes de agua potable en un futuro además de resguardar tal y como lo indica DIGECA en su informe los bienes constitucionales de la salud humana, la biodiversidad y el ambiente además de evitar futuras contaminaciones.
Ante esta solicitud de prohibición de la molécula se recomienda iniciar un proceso de coordinación con la Dirección de Productos de Interés Sanitario (DRPIS) y los jerarcas del Ministerio de Ambiente y Energía, así como del Ministerio de Agricultura y Ganadería con el fin de redactar un decreto que lleve a una prohibición en el menor tiempo posible (…)”.
Aunado a ello, se comprobó que, el 17 de marzo de 2023, se entregaron los resultados del remuestreo realizado los días 8 y 9 de noviembre de 2022, donde se evidencia nuevamente la presencia de los metabolitos del fungicida Clorotalonil, pero ahora en seis de las siete nacientes que abastecen dicho acueducto. En virtud de esta circunstancia, se emitieron tres órdenes sanitarias más, sean la MS-DRRSCE-DARSO-OS-0023-2023 dirigida al Presidente de la ASADA, con el fin de: 1) informar a la comunidad por la mayor cantidad de medios de comunicación, que la fuente de agua potable de la Nombre732 que utiliza la ASADA de Santa Rosa de Oreamuno no sea utilizada para consumo humano, preparación de alimentos o actividades de higiene y 2) coordinar con el Instituto Costarricense de Acueductos y Alcantarillados para que el agua suministrada a la población por medio de camiones cisterna o cualquier otro medio de transporte, provenga de otra fuente que no contenga contaminantes; y las MS-DRRSCE-DARSO-OS-0024-2023 y la MS-DRRSCEDARSO-OS-0025-2023, notificadas a las autoridades del Instituto Costarricense de Acueductos y Alcantarillados, para: 1) no utilizar la fuente de agua de la Nombre732 de la ASADA de Santa Rosa de Oreamuno, para suministrar a la población por medio de camiones cisterna o cualquier otro medio de transporte, agua que es usada para consumo humano, preparación de alimentos o actividades de higiene y 2) coordinar con el Presidente de la ASADA de Santa Rosa de Oreamuno, para que el agua suministrada a la población por medio de camiones cisterna o cualquier otro medio de transporte, provenga de otra fuente que no contenga contaminantes.
Al respecto, las autoridades del Ministerio de Salud, son enfáticas en indicar que, a la fecha en que se rindió informe en este recurso y luego de la notificación de las órdenes sanitarias de marzo de 2023, se cuenta con el reparto de agua potable por medio de camiones cisterna, pick up con tanqueta y la instalación de tanques de almacenamiento para autoconsumo; abastecen a los 853 abonados con los que cuentan, para un total de población de 3523 habitantes, según el Factor de Hacinamiento del distrito de Santa Rosa de Oreamuno de Cartago determinado por el INEC en el censo del 2011, brindando de este modo, agua apta para consumo humano a la población, como principio precautorio ante la problemática evidenciada en dicha comunidad y que mediante un trabajo en conjunto entre la Dirección Regional Central Este mediante el Ing. Nelson Artavia Vega y el Área Rectora de Salud de Oreamuno, mediante la Dra. María José Lafuente González, que se procedió con la conformación de la “Comisión Interinstitucional para el resguardo de las fuentes de agua utilizadas para consumo humano ubicadas en la Zona Norte de la provincia de Cartago”, dicha comisión está integrada por representantes de la ORAC Central Este AyA, UEN Gestión Ambiental del ICAA ,Dirección de Agua, Ministerio de Agricultura y Ganadería, Comisión para el Ordenamiento y Manejo de la Cuenca Alta del Río Reventazón – COMCURE, Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía SINAC – MINAE, Servicio Nacional de Salud Animal – SENASA.
El objetivo de dicha comisión es de plantear la hoja de ruta y trabajar en conjunto para el abordaje de los Acueductos de la Zona Norte de Cartago, inicialmente con los acueductos de los cantones de Oreamuno y Alvarado, dicha comisión ya cuenta con un Plan de Trabajo de Medidas Preventivas y un Plan de Trabajo de Medidas Reactivas, donde se plantea una ruta de trabajo en conjunto que permita el resguardo de las fuentes de agua utilizadas para consumo humano en dicha zona.
Por otra parte, se pudo comprobar que el Instituto Costarricense de Acueductos y Alcantarillados, en conjunto con las instancias competentes del Ministerio de Ambiente y Energía y del Servicio de Fitosanitario del Estado del Ministerio de Agricultura y Ganadería, han realizado una serie de actuaciones con el fin de participar de manera coordinada y poder atender cada una de las implicaciones de la contaminación de la ASADA que les corresponden según sus competencias, y es por ello, que han emitido una serie de informes técnicos referentes a los efectos negativos del Clorotalonil y son parte del equipo interinstitucional que está abordando la situación. Adviértase que, como parte de las acciones realizadas se propuso que los del MAG, Ministerio de Salud y MINAE, principalmente, elaboren un decreto amparado en el Artículo 29 de la Ley 7664, para regular la venta y/o uso de clorotalonil a nivel país.
En este decreto se sugiere establecer la venta restringida, únicamente autorizada bajo receta profesional, de manera que solamente las empresas que cuenten con regentes agrícolas puedan comercializar el producto, para lo cual se requiere la responsabilidad correspondiente de los regentes y la supervisión del Colegio de Ingenieros Agrónomos de Costa Rica. Esta acción sería una medida aplicada en amparo al principio precautorio, similar al que toma el Ministerio de Salud para emitir la orden sanitaria para el cierre de las ASADAS, y al principio pro natura, pero respaldado ante la evidencia técnica de los hallazgos en las fuentes del metabolito 1,3-dicarbamoil-2,4,5,6tetraclorobenceno (derivado del fungicida clorotalonil). Finalmente, las autoridades del Ministerio de Agricultura y Ganadería fueron claras en señalar que el Servicio Fitosanitario del Estado no tiene posibilidades de elaborar acciones articuladas con indicadores de desempeño con el fin de poder medir, monitorear y comparar los resultados obtenidos con el “Plan de manejo remedial para implementar en fuentes de agua de la ASADA Cipreses de Oreamuno” que determinen una mitigación o disminución de la contaminación a fin de obtener un “saneamiento” de las fuentes de agua.
De lo expuesto, en primer lugar, cabe aclarar que en el caso conocido por la Sala en la sentencia No. 2022-026065 de las 9:45 horas de 4 de noviembre de 2022, se acreditó la omisión de las autoridades administrativas en atender y ejecutar acciones concretas para solventar la problemática acusada, esto pese a conocer la situación de contaminación en los pozos de los cuales se abastecía la ASADA de Cipreses. Ahora bien, en el caso en estudio, si bien se ha comprobado que, en virtud de la contaminación existente en las nacientes de la ASADA de Santa Rosa de Oreamuno, las autoridades recurridas han adoptado acciones concretas encaminadas no sólo a la prevención del consumo humano, sino también para la solución del problema de contaminación, lo cierto es que, cada una de esas acciones se ha quedado plasmada en simples planes que se pretenden desarrollar a futuro o que a la fecha se encuentran como meras recomendaciones.
En este sentido, de especial relevancia para la resolución de este asunto, es el informe realizado el 14 de abril de 2023, por parte del Ministerio de Salud y en conjunto con el Ministerio de Ambiente y Energía y el Instituto Costarricense de Acueductos y Alcantarillados, denominado “Informe Técnico Clorotalonil”, en el cual se realizaron una serie de recomendaciones, tales como: “(…) Recomendaciones 1. Se recomienda aumentar la fiscalización y control por parte del Servicio Fitosanitario del Estado, y promover la sustitución del clorotalonil por otros plaguicidas más seguros y la adopción de Buenas Prácticas Agrícolas. De esta manera, se garantizará la protección del medio ambiente y la salud de la población en esta y otras regiones del país donde se utilice este pesticida. 2. Se recomienda el fortalecimiento del Laboratorio Nacional de Aguas para que cuente con los recursos necesarios para la cuantificación de los metabolitos del clorotalonil y que se pueda implementar a nivel nacional un programa de vigilancia y control en agua para consumo humano del clorotalonil y sus metabolitos. 3.
Por lo tanto, además de las recomendaciones emitidas en el oficio DIGECA-563-2022, se recomienda que el SFE realice un levantamiento de los plaguicidas más utilizados en el país y que el análisis de residuos en fuentes de agua, suelos y vegetales se priorice de acuerdo con el volumen de importación actualizado, incluyendo los metabolitos de estos plaguicidas de uso extendido vigente. 4. Es responsabilidad del Estado costarricense regular el uso de sustancias químicas en la agricultura, de manera que se garantice su correcta gestión y uso, sin que esto represente riesgos inaceptables para la salud humana y el medio ambiente. A pesar de que algunas sustancias pueden ser utilizadas de acuerdo con las recomendaciones de uso, es importante considerar los potenciales riesgos que pueden representar los metabolitos y residuos generados, y aplicar el principio precautorio para tomar decisiones informadas y proteger la salud y el bienestar de la población y del ecosistema 5.
Se hace necesario que las instituciones encargadas de la regulación y control de plaguicidas tomen medidas urgentes para prevenir y mitigar los impactos negativos asociados al uso de este plaguicida, lo que implica la implementación de estrategias de fiscalización efectivas, la promoción de prácticas agrícolas sostenibles y la eliminación gradual del clorotalonil de la industria agrícola del país. En definitiva, la protección de la salud humana y del ambiente debe ser el principal objetivo en cualquier estrategia de gestión de plaguicidas. 6. Con el fin de proteger los cuerpos de agua y reducir el riesgo de contaminación por el uso de plaguicidas, se recomienda la promoción de sistemas de aplicación localizada y el respeto a la zona de protección circundante, tal como lo establece el artículo 33 de la Ley N° 7575, Ley Forestal, para las áreas de protección de cuerpos de agua definidas en dicha ley.
Con estas medidas, se promueve la protección de los cuerpos de agua y la salud de la población que depende de ellos. 7. Basado en las alertas de peligrosidad del clorotalonil y la preocupación de que los productos registrados a base de este Ingrediente Activo de Grado Técnico (IAGT) no cuentan con el aval ambiental de DIGECA, se considera que, en pro de salvaguardar el ambiente, resulta fundamental que se cancelen los registros vigentes a base de este plaguicida. Lo anterior en apego a lo estipulado en el numeral ...04 y ...05 del Placa50 y el 16.2 del Placa51 y en el artículo 29 y 30 de la Ley 7664 Ley de Protección Fitosanitaria, referente a suspensiones y cancelaciones de registro. 8. En concordancia con las recomendaciones expuestas, así como de los riesgos analizados, se recomienda la prohibición del uso del clorotalonil en Costa Rica, en línea con las medidas adoptadas por la Unión Europea.
Se deben implementar medidas de seguridad y alternativas para la agricultura que minimicen la exposición de los trabajadores y de los consumidores, así como velar por la protección de las fuentes de agua, el medio ambiente y la salud de la población (…)” (el resaltado no es del original).
Nótese que, aunque se ha procurado la coordinación interinstitucional y las autoridades han efectuado informes como el transcrito anteriormente, en el que quedan claros los riesgos e implicaciones de continuar utilizando el clorotalonil como agroquímico en nuestro país, y en el que se emiten una serie de recomendaciones técnicas y certeras para atacar el problema que se denuncia en este recurso, no puede acreditarse de forma alguna que estas recomendaciones hayan sido ejecutadas de manera definitivo a la fecha en que se rindió informe en este recurso. Ciertamente, también se han emitido múltiples órdenes sanitarias, y se clausuraron de forma inmediata las Nombre733 de Cipreses y de Santa Rosa de Oreamuno; sin embargo, todavía para marzo de 2023, se estaba descubriendo la contaminación en una sexta naciente de las que nutren a la ASADA de Santa Rosa y la cual de previo a esto, se tenía como una naciente limpia, lo que quiere decir que, pese a las actuaciones realizadas la problemática descrita persiste y ninguna de las acciones que se han tomado ha logrado aún mitigar el grave impacto causando por el agroquímico en las nacientes de agua ni ha logrado dar una solución a la situación, dado que, los vecinos de la zona a la fecha continúan recibiendo el agua por medio de camiones cisternas, tal y como lo hacen desde la primera orden dada por esta Sala en noviembre de 2022 y no existe evidencia de que puedan volver a disfrutar del agua potable de manera libre y sin contaminación, como lo hacían anteriormente, en un futuro cercano.
Obsérvese que, no estamos solamente ante el riesgo de consumir agua contaminada, sino que se evidencia de los informes técnicos existentes en el expediente, que existe un riesgo de que esta agua contaminada se utilice para el riego de las sembradías de apio, brócoli, café, cebolla, chile dulce, coliflor, frijol, tomate, zanahoria, repollo, papa, entre otros productos que son cultivados en la zona norte de la provincia de Cartago; así como, a todas las especies que pueden encontrarse en la zona, tales como peces, anfibios, entre otros, que también en el caso de los peces son de consumo humano y los residuos que queden en todos estos productos y especies marinas, son a los que se verían expuestos los consumidores, por lo que, como se ha analizado en esta sentencia, el impacto podría ser mucho mayor del que se evidencia de manera preliminar.
Definitivamente, no corresponde a esta Sala determinar por medio de este proceso de amparo, si el agroquímico alegado por el recurrente es dañino o no, ni cuál es la gravedad que su utilización implica para el medio ambiente y para el ser humano y, por consiguiente, si debe prohibirse su comercialización y uso en el país o no (ver sentencia No. 7009-2019 de las 9:20 horas de 26 de abril de 2019). No obstante lo anterior, sí compete a esta Sala velar para que las instituciones del Estado actúen de manera coordinada en la protección del medio ambiente, de la salud y del agua potable. Nótese que, a diferencia de otros casos en los cuales esta Sala ha conocido el uso de algún agroquímico o plaguicida, como lo fue la utilización del glifosato, el cual fue analizado en la sentencia No. 7009-2019 y en el que existían una serie de criterios técnicos contrapuestos entre las mismas autoridades recurridas, lo cierto es que, en el sub lite, cada una de las autoridades, dependencias e instituciones involucradas, han manifestado su preocupación sobre el uso del clorotalonil, sus riesgos e impactos en el medio ambiente y en la salud.
De importancia para la resolución de este asunto, es lo estipulado en la Ley General de Salud, en los siguientes artículos:
“ARTICULO 2º.- Es función esencial del Estado velar por la salud de la población. Corresponde al Poder Ejecutivo por medio del Ministerio de Salubridad Pública, al cual se referirá abreviadamente la presente ley como "Ministerio", la definición de la política nacional de salud, la formación, planificación y coordinación de todas las actividades públicas y privadas relativas a salud, así como la ejecución de aquellas actividades que le competen conforme a la ley. Tendrá potestades para dictar reglamentos autónomos en estas materias. (…)
ARTICULO 239.- Ninguna persona natural o jurídica podrá importar, fabricar, manipular, almacenar, vender, transportar, distribuir o suministrar sustancias o productos tóxicos y sustancias, productos u objetos peligrosos de carácter radioactivo, comburente, inflamable, corrosivo, irritante u otros declarados peligrosos por el Ministerio, con riesgo o daño para la salud o la vida de las personas y sin sujeción estricta a las exigencias reglamentarias o a las especiales que el Ministerio pueda dictar para precaver tal riesgo o peligro. (…)

ARTICULO 342.- Corresponderá asimismo, el Ministro dictar las normas técnicas de salud a que deberán ceñirse las personas físicas o jurídicas de derecho privado o público en las materias que esta ley lo requiera (…)
Artículo 343.- Toda institución o establecimiento público, semipúblico o privado que realice acciones de salud, sean estas de prevención, promoción, conservación o recuperación de la salud física y mental en las personas o de rehabilitación del paciente, queda sujeto a las normas técnicas que el Ministerio dicte dentro de sus atribuciones, y al control y la vigilancia técnica de las autoridades de salud (…)
ARTICULO 344.- Quedan, asimismo, sujetos a las normas y al control y supervigilancia, aludidos en el artículo anterior, los organismos públicos o semipúblicos de administración descentralizada o desconcentrada en cualquier grado que administren servicios de interés público tales como el abastecimiento del agua potable, alcantarillado y recolección de residuos sólidos u otros que por la naturaleza de sus funciones puedan afectar o dañar gravemente la salud de la población, por ineficiencia técnica o insuficiencia de sus servicios (…)” (el resaltado no es del original).
En concordancia con lo establecido por la Ley General de Salud, el Reglamento para la calidad de Agua Potable, No. 38924-S, establece:
“(…) Artículo 4. Definiciones y Acrónimos. Para los fines del presente reglamento, se establecen las siguientes definiciones y acrónimos (…) hh) Vigilancia de la calidad del agua potable: Evaluación permanente desde el punto de vista de salud pública, efectuada por el Ministerio de Salud, sobre los entes operadores, a fin de garantizar la seguridad, inocuidad y aceptabilidad del suministro de agua potable desde el área de influencia de la fuente hasta el sistema de distribución (…)” Artículo 16. Vigilancia Estatal. Corresponde a cada DARS, realizar muestreos aleatorios de entes operadores ubicados en el área geográfica de su jurisdicción, como parte de un control cruzado. Se debe realizar al menos uno de los muestreos semestrales del sistema de suministro de agua seleccionado, utilizando laboratorios que cuenten con Permiso Sanitario de Funcionamiento vigente y con ensayos acreditados para los análisis respectivos.
(…) El informe del control cruzado, sustituirá el reporte de la calidad del agua del período correspondiente. En caso de que los resultados presenten el incumplimiento de uno o más de los parámetros, la DARS procederá a emitir una orden sanitaria, obligando la presentación del cronograma del plan de acciones correctivas (…)” (el resaltado no es del original).
De la normativa descrita anteriormente, se desprende que en Costa Rica es el Ministerio de Salud la autoridad que se encuentra obligada a definir la política nacional de salud; además, dentro de las potestades de este Ministerio se encuentran fiscalizar y vigilar por medio de las Áreas Rectoras de Salud de cada localidad la calidad del agua potable que está siendo suministrada en cada zona del país a los diferentes consumidores y la posibilidad de dictar las órdenes e implementar las acciones que considere convenientes en aras de realizar esta vigilancia, así como coordinar con las demás autoridades según sus competencias cualquier otra acción que se requiera, en aras de la protección del agua que se brinda a los usuarios de los diferentes servicios de agua potable a nivel nacional, y de la salud y la vida de estos.
Bajo este panorama, de los hechos y reclamos que se tuvieron por acreditados en este recurso, se desprende que, pese a los esfuerzos realizados por las instituciones recurridas y al interés en la regulación del tema, a la fecha el problema que se acusa persiste y ninguna de las acciones que se están realizando muestra una solución cercana. Adviértase que, en ninguno de los informes rendidos ante esta Sala se logra evidenciar de manera clara y contundente cuál es la dimensión del daño causado ni cómo se puede contrarrestar el daño para buscar una solución real y efectiva al problema en que se encuentran los vecinos del lugar y el medio ambiente en general de la zona, así como tampoco se pudo verificar que exista algún acuerdo en firme en aras de regular el tema de la aplicación del clorotalonil en el país, por lo que resulta importante que la acción coordinada de las diferentes autoridades conduzca a la definición de la situación a la brevedad posible.
Nótese que las mismas autoridades del Ministerio de Salud, son enfáticas en señalar que “se puede iniciar un proceso de saneamiento de las fuentes contaminadas en Cipreses de Oreamuno y en Santa Rosa de Oreamuno, en miras de buscar la rehabilitación y reapertura de las fuentes de agua potable en un futuro”; no obstante, no existe evidencia de que este proceso haya iniciado, lo que fundamenta aún más la necesidad de la articulación y verificación entre todas las instituciones involucradas de manera coordinada, que permita la utilización e implementación de técnicas en conjunto, con el fin de lograr un tratamiento que pueda realizar el saneamiento tan necesario en las fuentes de agua contaminada y concluir las demás aristas que este proceso implique, dentro de las que se encuentran, por supuesto, la correcta regulación en el país de la utilización de clorotalonil o en su defecto la prohibición de este producto, para evitar situaciones en el futuro como las que se están viviendo actualmente en las comunidades afectadas por la contaminación apuntada, articulación y verificación que, como se indicó previamente, le corresponde realizar al Ministerio de Salud como autoridad encargada de vigilar la calidad del agua potable en nuestro país, según consta en las potestades que se encuentra enumeradas en la normativa aplicable al efecto y que fueron mencionadas de previo, lo cual le permitirá a dicho Ministerio el abordaje de las recomendaciones que fueron brindadas en el informe sin número denominado “Informe Técnico Clorotalonil” emitido el 14 de abril de 2023 y la coordinación que estime necesaria con el resto de autoridades involucradas, según sus competencias, lo que podría implicar incluso la posibilidad técnica de un saneamiento de las fuentes de agua, tal y como ha sido analizado en anteriores ocasiones por esta jurisdicción (ver en ese sentido las sentencias número 2020-6275 de las 9:20 horas de 27 de marzo de 2020, 2019-7690 de las 9:15 horas de 3 de mayo de 2019, 2019-695 de las 9:15 horas de 18 de enero de 2019, 2009-9041 de las 10:30 horas de 29 de mayo de 2009, y 2009-9040 de las 10:29 horas de 29 de mayo de 2009).
En mérito de lo expuesto, lo procedente es la estimatoria del recurso, con las consideraciones que se dirán en la parte dispositiva de esta sentencia.
IX.Nota del Magistrado Salazar Alvarado. En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa que las autoridades recurridas, han omitido cumplir con su deber de proteger la salud y el ambiente, pues aún no han puesto fin al supuesto problema de contaminación por la operación de aguas por el uso de un plaguicida, lo que amenaza lesionar el derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
X.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena: 1) a Alexei Carrillo Villegas y a Fiorella Fait Wong, por su orden Ministro a.i. de Salud y Directora a.i. del Área Rectora de Salud de Oreamuno, o a quienes, en su lugar ejerzan esos cargos, para que de conformidad con las potestades que les reconoce la legislación vigente, de inmediato establezcan todas las instancias de coordinación correspondientes con las autoridades del Ministerio de Agricultura y Ganadería, del Ministerio de Ambiente y Energía, y del Instituto Costarricense de Acueductos y Alcantarillados, dentro de sus respectivos ámbitos de competencias, para que dentro del plazo de seis meses, contado a partir de la notificación de esta sentencia, y en consonancia con los parámetros establecidos por el Ministerio de Salud, se adopten y ejecuten las recomendaciones del informe sin número de 14 de abril de 2023, emitido por el Ministerio de Salud, el Ministerio de Ambiente y Energía y el Instituto Costarricense de Acueductos y Alcantarillado, denominado “Informe Técnico Clorotalonil”, para garantizar el derecho a la salud y a la vida de las personas; se brinde seguimiento a tales recomendaciones, y se emitan las actuaciones pertinentes para garantizar su adecuado y oportuno cumplimiento; y 2) a Jorge Zapata Arroyo y José Sánchez Redondo, por su orden Gerente General del Instituto Costarricense de Acueductos y Alcantarillados y Presidente con representación judicial y extrajudicial de la ASADA de Santa Rosa de Oreamuno de Cartago, o a quienes, en su lugar ejerzan esos cargos, para que de manera inmediata mantengan y garanticen la prestación del servicio de agua potable para consumo humano mediante las vías que corresponda, sin que se utilice para ello ninguna de las fuentes de agua contaminadas, y que tal situación se mantenga, hasta que el servicio pueda ser debidamente restablecido por los medios habituales sin comprometer la seguridad y la salud, y previa autorización al respecto por parte del Ministerio de Salud.
Lo anterior, bajo apercibimiento de que, de no acatar esta orden, incurrirá en el delito de desobediencia y que de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Asimismo, se condena a la ASADA de Santa Rosa de Oreamuno de Cartago al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo civil.
El Magistrado Salazar Alvarado consigna nota. La Magistrada Garro Vargas salva el voto respecto a la ejecución de la primera orden de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.- Nombre318 .

Res. N.º PHO665 Voto salvado parcial de la magistrada Garro Vargas respecto a la ejecución de la primera orden de esta sentencia.
Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde corresponde residenciar la fase de ejecución del asunto, en lo que respecta a la primera orden, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar a dicha orden un adecuado seguimiento.
Como bien se sabe, de conformidad con la Ley de la Jurisdicción Constitucional (LJC) la ejecución de las órdenes dictadas por la Sala Constitucional corresponde, en principio, ser fiscalizada por la propia Sala. Sin embargo, el art. 56 de la LJC contempla supuestos de excepción en los que, por determinación de la propia Sala, se ordene residenciar la ejecución de la sentencia en la jurisdicción contencioso-administrativa. La norma en cuestión establece lo siguiente:
“Art. 56. La ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones y responsabilidades pecuniarias, o en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción.” (Lo destacado no corresponde al original).
Recuérdese que en el proyecto de ley de discusión de la LJC se preveía originalmente lo siguiente:
“Art. 56. Las sentencias favorables al recurrente se ejecutarán en la vía contencioso-administrativa por el procedimiento de ejecución de sentencia previsto en la ley Reguladora de esa Jurisdicción.” (Lo destacado no corresponde al original).
Sin embargo, el texto fue modificado vía moción para que la norma fuera coincidente con lo regulado en el art. 153 de la Constitución Política, pero se realizó la siguiente explicación:
“EL SECRETARIO:
Moción No. 68 (32-19) del diputado Chacón Jiménez:
“artículo 57 (antes 56): para que el texto se lea así: “la ejecución de las sentencias corresponde a la Sala Constitucional, salvo en lo relativo a la liquidación y cumplimiento de indemnizaciones o responsabilidades pecuniarias en otros aspectos que la propia Sala considere del caso, en que se hará en la vía contencioso administrativa por el procedimiento de ejecución de sentencia previsto en la ley reguladora de esa jurisdicción”.

Aquí había una contradicción con la tesis genérica de que son los Tribunales los que ejecutan sus sentencias y enviaba la Jurisdicción Contencioso Administrativo toda la ejecución; entonces quedaban al aire los otros artículos que le permitían a la Sala ejecutarlos.

En esa parte dice: “o en otros aspectos que la propia Sala considere del aso…”, a qué se está refiriendo?

La idea es que la Sala, en la vía de ejecución de sentencia, resuelva lo que ella considere que le corresponde. Lo que demás, lo envía a la vía Contencioso Administrativa.

A partir de lo anterior, está claro que la propia LJC autoriza a esta Sala a que resuelva lo que ella considera que le atañe y podría, de estimarlo así, derivar en la jurisdicción contenciosa administrativa los aspectos que ella valore que así corresponde.
En el caso concreto, la primera orden dice lo siguiente:
“1). a Alexei Carrillo Villegas y a Fiorella Fait Wong, por su orden Ministro a.i. de Salud y Directora a.i. del Área Rectora de Salud de Oreamuno, o a quienes, en su lugar ejerzan esos cargos, para que de conformidad con las potestades que les reconoce la legislación vigente, de inmediato establezcan todas las instancias de coordinación correspondientes con las autoridades del Ministerio de Agricultura y Ganadería, del Ministerio de Ambiente y Energía, y del Instituto Costarricense de Acueductos y Alcantarillados, dentro de sus respectivos ámbitos de competencias, para que dentro del plazo de seis meses, contado a partir de la notificación de esta sentencia, y en consonancia con los parámetros establecidos por el Ministerio de Salud, se adopten y ejecuten las recomendaciones del informe sin número de 14 de abril de 2023, emitido por el Ministerio de Salud, el Ministerio de Ambiente y Energía y el Instituto Costarricense de Acueductos y Alcantarillado, denominado “Informe Técnico Clorotalonil”, para garantizar el derecho a la salud y a la vida de las personas; se brinde seguimiento a tales recomendaciones, y se emitan las actuaciones pertinentes para garantizar su adecuado y oportuno cumplimiento”.
Sobre dicho informe, el hecho probado 30) de la sentencia señala:
“El 14 de abril de 2023, el Ministerio de Salud en conjunto con el Ministerio de Ambiente y Energía y el Instituto Costarricense de Acueductos y Alcantarillados, emitieron el “Informe Técnico Clorotalonil”, en el que se concluyó y recomendó lo siguiente: “(…) Conclusiones 1. La Sala Constitucional ha reconocido en varias ocasiones que tanto la salud pública como el derecho a un ambiente sano y ecológicamente equilibrado son derechos fundamentales, reconocidos tanto a nivel constitucional como internacional. El ejercicio legítimo de estos derechos requiere que los recursos sean utilizados de manera racional, y corresponde al Estado la protección del ambiente, según el principio precautorio que rige en materia ambiental. La administración debe realizar evaluaciones ambientales rigurosas y detalladas y compartir los resultados con la población afectada para garantizar que las actividades económicas con impacto ambiental no impliquen un riesgo o amenaza de daño permanente e irreversible al ambiente.
La desatención e inobservancia de estos aspectos definidos normativa y jurisprudencialmente puede resultar en la vulneración del derecho a un ambiente sano y a la salud pública. En este sentido, el Estado costarricense tiene el poderdeber de procurar por la tutela efectiva y oportuna de estos derechos fundamentales, elevando el nivel de vida de la población 2. El clorotalonil se utiliza principalmente como fungicida en una amplia gama de cultivos, incluyendo hortalizas y frutas. Se han identificado más de 20 metabolitos de este fungicida, incluyendo el 4-hidroxiclorotalonil y el ácido 3-carbamil-2,4,5-triclorobenzoico, que son medianamente móviles y persistentes. 3. El clorotalonil ha sido prohibido en la Unión Europea debido a su potencial carcinogénico y su capacidad para contaminar las aguas subterráneas con metabolitos de su degradación. Aunque el clorotalonil ha sido prohibido, sus metabolitos continúan siendo un problema persistente en el medio ambiente y en el suministro de agua potable.
En Suiza, se ha detectado la presencia de subproductos del clorotalonil en aguas subterráneas y en el agua potable en varios cantones, con niveles que exceden las normas legales establecidas para el agua potable. También se han encontrado metabolitos de clorotalonil en aguas superficiales como el río Rhine y el Lago Zúrich. 4. El clorotalonil es una molécula que, aunque presenta baja potencial de lixiviación, puede ser altamente tóxica para peces e invertebrados acuáticos cuando se aplican durante periodos de lluvia. Además, sus productos de degradación, como el 4-hidroxiclorotalonil, pueden ser tóxicos para mamíferos y aves, incluyendo efectos reproductivos y carcinogénicos. También se ha encontrado residuos de metabolitos del clorotalonil en alimentos, como los arándanos, hasta 76 días después de la aplicación 5. A la luz de la evidencia presentada, se puede concluir que el clorotalonil presenta riesgos significativos para la salud humana y el medio ambiente.
La Agencia de Protección Ambiental de los Estados Unidos ha clasificado el clorotalonil como un posible carcinógeno humano y un posible agente tóxico para la reproducción y el desarrollo, y la exposición a este compuesto puede causar irritación en la piel, los ojos y las vías respiratorias, así como náuseas, dolor de cabeza y mareos. Por su parte, la Autoridad Europea de Seguridad Alimentaria ha identificado problemas críticos además la evaluación del riesgo para los consumidores derivado de la exposición alimentaria no pudo completarse debido a la falta de datos del expediente, lo que sugiere que el uso de este fungicida puede representar un riesgo desconocido para la salud pública. 6. En conclusión, la evaluación realizada por la EFSA indica que la exposición crónica al clorotalonil a través de la dieta puede representar un riesgo para la salud humana, especialmente para los grupos de población más vulnerables.
Además, se ha identificado la presencia de metabolitos altamente contaminantes del Clorotalonil en fuentes de agua destinadas al consumo humano, lo que demuestra el riesgo potencial de contaminación. A pesar de que aún se sabe poco acerca de los efectos que estos compuestos pueden tener en la salud humana, se debe aplicar el principio precautorio en la toma de decisiones y tomar medidas preventivas para minimizar la exposición a estos compuestos. La prohibición del uso del clorotalonil en la Unión Europea es un ejemplo de cómo se está aplicando el principio precautorio para proteger la salud humana y el medio ambiente. 7. En la provincia de Cartago, Costa Rica se cuenta con ocho nacientes destinadas para consumo humano, las cuales están siendo contaminadas debido a la invasión de zonas de protección y de recarga de acuíferos por la actividad agrícola y ganadera. Se ha detectado la presencia de metabolitos de clorotalonil en los acueductos de Cipreses y Santa Rosa del cantón de Oreamuno.
Por lo tanto, es necesario tomar medidas para evitar la contaminación de más fuentes de agua y proteger la salud de la población. 8. Se concluye que existe una preocupación ambiental sobre el clorotalonil, por su toxicidad principalmente para organismos acuáticos tanto a nivel de toxicidad aguda como crónica, y el peligro que representan sus metabolitos por su potencial de contaminar aguas tanto superficiales como subterráneas. Además, éste es un plaguicida de uso común en hortalizas y es preocupante que el país no cuenta con capacidades técnicas para la correcta vigilancia y monitoreo de sus metabolitos en suelos y aguas, igual como ocurre con otros plaguicidas de alto uso en la actualidad. 9. Ante la problemática del uso del plaguicida clorotalonil en fuentes de agua, el MAG propone opciones como la sustitución por otros plaguicidas con el mismo mecanismo de acción, promoción de sistemas de aplicación localizada y el respeto a la zona de protección circundante. 10.
Se evidencia que existe un debilitamiento en la fiscalización, regulación y control del uso del plaguicida clorotalonil en Costa Rica por parte del MAG, lo cual ha generado una problemática ambiental y de salud pública en la zona de aplicación. 11. La opción de sustituir el clorotalonil por biopesticidas o controladores biológicos es una alternativa que no es ampliamente abordada por el MAG en su plan remedial. Sin embargo, esta alternativa debe ser analizada caso por caso, identificando controladores por plaga y por cultivo, así como pruebas de eficacia. 12. Es necesario identificar los cultivos en la zona, las plagas tratadas y confirmar los debidos registros ante el SFE para comprender la problemática suscitada por el clorotalonil. Se deben establecer planes de trabajo que permitan identificar si se están aplicando correctamente las BPA, posibles sustituciones por otros plaguicidas y/o biopesticidas.
Cabe destacar que la sustitución del clorotalonil no garantiza la eliminación del uso de plaguicidas en su totalidad, ya que algunos productos alternativos están siendo reevaluados por sus efectos en la salud y el ambiente. Recomendaciones 1. Se recomienda aumentar la fiscalización y control por parte del Servicio Fitosanitario del Estado, y promover la sustitución del clorotalonil por otros plaguicidas más seguros y la adopción de Buenas Prácticas Agrícolas. De esta manera, se garantizará la protección del medio ambiente y la salud de la población en esta y otras regiones del país donde se utilice este pesticida. 2. Se recomienda el fortalecimiento del Laboratorio Nacional de Aguas para que cuente con los recursos necesarios para la cuantificación de los metabolitos del clorotalonil y que se pueda implementar a nivel nacional un programa de vigilancia y control en agua para consumo humano del clorotalonil y sus metabolitos. 3.
Por lo tanto, además de las recomendaciones emitidas en el oficio DIGECA-563-2022, se recomienda que el SFE realice un levantamiento de los plaguicidas más utilizados en el país y que el análisis de residuos en fuentes de agua, suelos y vegetales se priorice de acuerdo con el volumen de importación actualizado, incluyendo los metabolitos de estos plaguicidas de uso extendido vigente. 4. Es responsabilidad del Estado costarricense regular el uso de sustancias químicas en la agricultura, de manera que se garantice su correcta gestión y uso, sin que esto represente riesgos inaceptables para la salud humana y el medio ambiente. A pesar de que algunas sustancias pueden ser utilizadas de acuerdo con las recomendaciones de uso, es importante considerar los potenciales riesgos que pueden representar los metabolitos y residuos generados, y aplicar el principio precautorio para tomar decisiones informadas y proteger la salud y el bienestar de la población y del ecosistema 5.
Se hace necesario que las instituciones encargadas de la regulación y control de plaguicidas tomen medidas urgentes para prevenir y mitigar los impactos negativos asociados al uso de este plaguicida, lo que implica la implementación de estrategias de fiscalización efectivas, la promoción de prácticas agrícolas sostenibles y la eliminación gradual del clorotalonil de la industria agrícola del país. En definitiva, la protección de la salud humana y del ambiente debe ser el principal objetivo en cualquier estrategia de gestión de plaguicidas. 6. Con el fin de proteger los cuerpos de agua y reducir el riesgo de contaminación por el uso de plaguicidas, se recomienda la promoción de sistemas de aplicación localizada y el respeto a la zona de protección circundante, tal como lo establece el artículo 33 de la Ley N° 7575, Ley Forestal, para las áreas de protección de cuerpos de agua definidas en dicha ley.
Con estas medidas, se promueve la protección de los cuerpos de agua y la salud de la población que depende de ellos. 7. Basado en las alertas de peligrosidad del clorotalonil y la preocupación de que los productos registrados a base de este Ingrediente Activo de Grado Técnico (IAGT) no cuentan con el aval ambiental de DIGECA, se considera que, en pro de salvaguardar el ambiente, resulta fundamental que se cancelen los registros vigentes a base de este plaguicida. Lo anterior en apego a lo estipulado en el numeral ...04 y ...05 del Placa50 y el 16.2 del Placa51 y en el artículo 29 y 30 de la Ley 7664 Ley de Protección Fitosanitaria, referente a suspensiones y cancelaciones de registro. 8. En concordancia con las recomendaciones expuestas, así como de los riesgos analizados, se recomienda la prohibición del uso del clorotalonil en Costa Rica, en línea con las medidas adoptadas por la Unión Europea.
Se deben implementar medidas de seguridad y alternativas para la agricultura que minimicen la exposición de los trabajadores y de los consumidores, así como velar por la protección de las fuentes de agua, el medio ambiente y la salud de la población (…)”.
Es palmario que se trata de una orden que reviste extrema complejidad, cuya ejecución difícilmente puede seguirse con eficacia en esta Sala Constitucional. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (art. 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la LJC, a mi juicio, la ejecución de esta primera orden debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Por lo anterior, salvo el voto parcialmente, respecto de la ejecución de la primera orden de esta sentencia, la cual, de conformidad con el art. 56 de la LJC, corresponde ser residenciada en el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda. A tales efectos, ordeno remitir una copia de esta resolución para que se inicien los procedimientos de ejecución de este fallo.
