Document Review Decision No. PHO7178 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty a.m. on August 4, 2023.
Proceeding for constitutional protection (recurso de amparo) processed under case number 23-012941-0007-CO, filed by [Nombre317 001], identity card number [Valor CED165], against the MUNICIPALIDAD DE SAN RAMÓN AND THE MINISTERIO DE SALUD.
Background:
That the institution was compelled, due to the condition and size of the municipal vehicle fleet, to hire a company to provide waste collection services; that company has trailers with a capacity of 25 tons of waste, which is transported to the Miramar sanitary landfill (relleno sanitario). It states that, if the service were provided directly using collection trucks, the cost would increase, which would affect the fee charged to the public for the service. • That, for the information of that Ministry of Health, the Constitutional Chamber had ordered the site closed because operations were conducted in the open air and because the pollution was unbearable, given the large flock of vultures that gathers there; and that the Ministry of Health is, unwittingly, complicit in the resulting harm by allowing this dump to operate WITHOUT POTABLE WATER. The reported site is being used solely for the temporary storage and daily transfer of solid waste to the Tecno Ambiente Sanitary Landfill, and it is therefore concluded that there is no open-air dump (vertedero a cielo abierto) at the site.
There is a considerable number of vultures, which suggests that measures to reduce this bird population are not being implemented, in breach of the measures proposed in the document entitled Analysis, Specifications, and Recommendations for Compliance with the Technical Closure Process for the Municipal Open-Air Dump, Piedades Norte de San Ramón, which set forth the following proposals: • Techniques such as traps must be used; addressing the birds requires a combination of techniques such as nets, acoustic deterrent devices, or even dogs. The project plans provide for a system of acoustic strobe-light alarms to help frighten away the birds; however, this has not been implemented. It is important to mention that official letter MS-DARSSR-RS-0589-2023 stated that the lack of a potable-water supply is a critical issue within the operation, because such a supply is vitally necessary to reduce the risk of illness among workers.
The document concerning the technical closure established 25 February 2021 as the deadline for complying with this requirement, but this commitment was breached. Article 55 of the Regulations on Ordinary Solid Waste Management provides: Physical and sanitary specifications to be met by transfer stations: j) Have a permanent water supply for cleaning floors and vehicles. Therefore, the Municipalidad de San Ramón was ordered to make the necessary arrangements to provide a water-supply service in the areas where workers are located, so as to reduce risks to their health. It is observed that a daily record of the quantities of waste received is maintained at the site in both physical and digital form. Recoverable waste (residuos valorizables) is collected separately and delivered to two authorized waste managers in the western region. It is important to mention that the Municipalidad de San Ramón took steps to legalize the transfer operation by submitting an application for an operating permit to this Ministry of Health on 6 July of the current year; that application is under review by the Customer Service Unit of this Health Governing Area (see folios 00001 through 00015).
The Constitutional Chamber must likewise be informed that health order (orden sanitaria) OS-SR-R-160-2023 is still within the compliance period for submission of the Corrective Action Plan and legalization of the Municipalidad de San Ramón waste-transfer center, which expires on 21 July of the current year. It must be mentioned that the absence of a sanitary operating permit (permiso sanitario de funcionamiento) from the Ministry of Health would require this institution, as provided in the Operating Permit Regulations, to issue an order closing the operation. However, Ministerial Directive N° DM-RM-4805-2014 provides as follows: “…that, where grounds exist for closing public operations and establishments, the matter must be referred to the head of the institution for an opinion…because of this, and based on the premise that the factors specific to each individual case must be analyzed by those who have conducted the proceedings…the analysis must initially be performed at the local level and referred to the Regional Directorates for the technical, legal, and social analysis needed to make the best decision for the benefit of Public Health and the well-being and safety of the population…this begins with an assessment at the local level by the Directorate of the Health Governing Area, which orders the corresponding inspection and, if instances of noncompliance are found, authorizes issuance of the health order and grants a period based on the complexity of the deficiencies identified; if these orders are not complied with, the local level must analyze whether closure of the establishment should be recommended, based on the criterion of safeguarding public health and the safety of the inhabitants.
“The corresponding arrangements are being made with the amparo petitioner concerning the noise-pollution issue, as established in the control regulations and the Noise Measurement Procedure Nº 32692. However, it has not yet been possible to set a specific date due to a circumstance attributable to the amparo petitioner, who has stated that his work commitments make it difficult to establish a date…” III. The foregoing is supported by the following administrative acts issued before the filing of this writ of amparo (recurso de amparo): In response to these facts, the corresponding inspection was performed, as documented in report MS-DARSSR-RS-0589-2023, dated 15 June 2023. It is clarified that official letter MS-DARSSR-RS-667-2023 7 July 2023 corrected the date on which the written inspection report was prepared, so as to state correctly the date 28 April 2023. The conclusions and recommendations are presented below: “In response to work assigned on 13 June of the current year, whereby responsibility was assigned for addressing complaint SR-131-2023, which concerns the operation of a ‘garbage dump’ owned by the Municipalidad de San Ramón, I hereby report that an assessment visit regarding the matter was conducted on that same date, after prior coordination with Mr. [Nombre317 001], the complainant, who states that he owns a property located in San Ramón de Alajuela that borders the Municipalidad de San Ramón garbage dump to the north, a property measuring 44.308.86 square meters and identified on survey plan N° A-448536-97.
All matters raised in the written submission dated 28 March 2023 were addressed. • He states that, at the site of the ‘garbage dump,’ the Municipality failed to take into account the existence of a spring (naciente) within his property, which is used by his family and is located only 50 to 60 meters from where the garbage is dumped and collected. The property was inspected in the company of Mr. Nombre10386, proceeding as far as the site of a water-storage tank located approximately 70 meters from the Municipalidad de San Ramón waste-storage center. Access to this waste-transfer center is provided through a right-of-way easement (servidumbre de paso), which the Municipalidad de San Ramón maintains with respect to paving, roadside clearance, and stormwater channels. Although some garbage was observed in the gutters during the inspection, this can be remedied through a proper maintenance plan.
Mr. Nombre10386 states that the collected water is used by his family for consumption and is conveyed to his home through a pumping system. There is no record that a concession has been granted for this water source to be used for human consumption. The collection tank is properly roofed, and a certain amount of feces produced by the vultures that gather at this location was observed in its vicinity. Regarding this concession, it is important to mention that Mr. [Nombre317 001] submitted a public notice under expediente number 8294 A, requesting a concession for an unnamed spring on Nombre317 property at coordinates 232.250/482.350. The corresponding review established that this is a spring located in the community of Bolívar, 1.162,93 m. from the reported transfer center, and that it is registered in the National Comprehensive Water Resources Management System of the Water Directorate of the Ministerio de Ambiente y Energía under the Nombre317 of Ms.
Nombre10387. • The complainant also states that the workers employed at the ‘dump’ do not have potable water and must drink water from a contaminated well. Regarding this and other matters falling within municipal jurisdiction, an assessment visit was conducted on 14 June of this year in the company of Lic. Allan Artavia Jiménez, head of the Environmental Services Unit of the Municipalidad de San Ramón, confirming that this property does not, in fact, have a potable-water supply service. To address this problem, potable water is supplied to the workers every day for handwashing and for filling the toilet tank. The security guard states that they also bring water from home to meet their daily needs. He tells us that a water-storage tank is located on the upper part of this building, but that it has not been used for several months. Lic. Artavia states that he will take charge of the matter so that this storage tank is periodically filled, with the aim of maintaining a permanent water supply.
Within this property, which is used as a transfer center for waste collected in the canton, including waste from Dirección2221, several areas are used as offices and a dining area. Potable-water dispensers supplied by the Municipality are available at these locations for use by the workers. Water from a well located on the property is used for the sanitary facilities and for cleaning floors and other areas. • Regarding the treatment ponds, the complainant states that none exist and that liquids and acids from the spring flow into the Río Barranca. It is observed that there are two ponds for storing leachate (lixiviados), neither of which is roofed, creating a risk of overflow, particularly during the rainy season. Mr. Nombre10386 asserts that there are no ditches or drains and that, even so, the Municipality claims that Nombre4361 granted them the feasibility approval, which is serious. During the assessment visit, ditches for managing stormwater were observed, principally for water generated at the large shed being used for the temporary deposit and storage of waste that is transferred to the Relleno Sanitario Tecno ambiente.
Some deficiencies were identified in the perimeter channels and drains used for the small quantities of leachate generated there. It is important to indicate that the collection trucks responsible for transporting the waste to the sanitary landfill located in Miramar have leachate-collection systems, and the leachate is deposited at that Landfill’s treatment plant. Irregularities in some of the existing inspection chambers must be corrected. • There are no vents of any kind, and everything is an artificial simulation staged for inspection.” Regarding this point, it is important to mention that these activities pertain to the technical closure project for the controlled landfill (vertedero controlado) that operated on this property for many years. In April 2022, a document was submitted to this Ministry of Health describing the actions that the Municipality has been carrying out to fulfill this obligation: • Inspection of the existing gas vents (chimeneas) to assess current emissions. • Drilling of new wells and reconditioning of existing wells. • Installation of interconnection piping. • Installation of burners, among other measures. • Conducting sampling to determine levels of carbon dioxide, methane, and hydrogen sulfide.
There is no evidence that, during 2023, a schedule of the activities being carried out at the site to fulfill the technical closure requirements was submitted to this Ministry of Health, in violation of Article 38 of the Reglamento sobre Rellenos Sanitarios Nº 38928-S. Article 38. The Authorized Operator (Gestor Autorizado) responsible for operating a sanitary landfill (relleno sanitario) or converting a landfill into a sanitary landfill must register semiannual operational reports through the SINIGIR platform. c. Progress of the landfill or closure works. d. Updated useful life. e. Laboratory analyses conducted quarterly for mechanized landfills and landfill closure works, and semiannually for manual landfills, covering the monitoring wells and the receiving body for effluent from the leachate (lixiviados) treatment system. • That the Municipalidad de San Ramón is dumping garbage scarcely 60 meters from the water spring (naciente) that supplies my family.
As indicated in the preceding paragraphs, it can be observed that a spring is located on the property of Mr. Nombre10386, approximately 136.18 meters from the municipal transfer center, with an elevation difference of 20 meters relative to the waste-transfer area; according to Lic. Artavia, it is preserved within a forested area of approximately 8 hectares and has been captured for use. There is no record that a concession has been granted for the use of this spring for human consumption. • That, in light of this situation, it is important for that Ministry to take action to minimize the health impact being caused by this dumpsite, and the Municipalidad de San Ramón could send the garbage directly to Miramar. In response to this assertion, it is important to clarify that, according to information provided and contained in the case file, in compliance with Resolution N° 20170011798 of the Sala Constitucional, beginning on January 22, 2020, the Municipalidad de San Ramón ceased disposing of solid waste at the municipal landfill and began transporting and disposing daily of the waste generated in the canton at the Relleno Sanitario de Miramar (Tecno Ambiente).
Regarding the complainant’s proposal to transport the waste directly to the Relleno Sanitario de Miramar, Lic. Artavia was consulted and stated verbatim as follows: “To transport the ordinary solid waste generated in the canton to Miramar each day, the Municipalidad de San Ramón built a transfer center for ordinary and nontraditional solid waste, where the waste contained in collection trucks and in the vehicles of private individuals arriving at this center is transferred to a trailer or container capable of carrying 25 tons of waste, which is towed by a truck to the sanitary landfill. • That, for the information of that Ministry of Health, the Sala Constitucional had ordered the closure of the site because operations were conducted in the open air and because the pollution is unbearable, given the large number of vultures that gather there, and that the Ministry of Health is, albeit unintentionally, complicit in the resulting harm by allowing this dumpsite to operate WITHOUT POTABLE WATER.
It was verified at the site that the work conducted there consists solely and exclusively of the daily deposit and transfer of solid waste to the Relleno Sanitario Tecno Ambiente; therefore, it is concluded that there is no open-air landfill (vertedero a cielo abierto) at the site. A considerable number of vultures is indeed evident in the area, suggesting that measures to reduce this bird population have not been implemented, in breach of the proposals contained in the document entitled Análisis, especificaciones y recomendaciones para el cumplimiento del proceso de cierre técnico del vertedero municipal a cielo abierto, Piedades Norte de San Ramón, which set forth the following proposals: • Techniques such as traps must be used; addressing the birds requires a combination of techniques such as nets, acoustic deterrent devices, or even dogs. It is stated that the project plans provide for the distribution of acoustic strobe-light alarms to help frighten away the birds.
The lack of a potable-water supply is a critical issue within the operation, since such a supply is vitally necessary to reduce the risk of disease among workers. It is noted that the document relating to the technical closure established February 25, 2021, as the deadline for complying with this requirement, and this commitment has been breached. Article 55 of the Reglamento sobre manejo de residuos sólidos ordinarios provides as follows: Physical and sanitary specifications that transfer stations must meet: j) Have a permanent water supply for cleaning floors and vehicles. Therefore, although there is currently no water-supply service provided by a public entity, there is a permanent water supply for the activities specified in the preceding article, and it may thus be concluded that the regulation is being complied with. Nevertheless, pursuant to the precautionary principle (principio precautorio), the Municipalidad de San Ramón must be ordered to make the necessary arrangements to obtain water-supply service in the areas where workers are located, thereby reducing the risk to their health.
It is observed that the site maintains a daily record, in both physical and digital form, of the quantities of waste received. Recoverable waste (residuos valorizables) is collected separately and delivered to two authorized operators in the western region. Conclusions and recommendations: Based on the results obtained in this report, it can be determined that: • No open-air garbage dump is located at the site reported by Mr. [Nombre317 001]. This site operates as a waste transfer center, and the waste is transported to and treated at the Relleno Sanitario Tecno Ambiente. • The spring being exploited by Mr. Nombre10386 is not subject to a concession registered with the Departamento de Aguas del Minae. • There are indeed ponds for managing leachate, but they have structural and maintenance deficiencies because they currently have neither roofs nor monitoring logs. These actions form part of the technical closure project for the garbage landfill that operated on this property for many years. • The existence of gutters and drainage systems was confirmed, with irregularities that must be corrected. • Some gas vents were observed; however, there is a lack of burners, and no laboratory analyses exist for the emitted gases. • The spring located on land adjacent to the transfer center is 136.18 meters away; what is located approximately 70 meters away is the collection tank for this body of water, which is not subject to a concession. • The transfer center is a high-impact facility because it serves the entire population of the canton of San Ramón; consequently, changing its purpose or proceeding with its closure could adversely affect the community it serves. • The Reglamento sobre manejo de residuos sólidos ordinarios states that transfer stations must have a permanent water supply for cleaning floors and vehicles.
This requirement is currently being met because a water-supply well is available for these activities. However, the Municipalidad de San Ramón committed to correcting the water-supply problem in the locations where workers remain continuously, and it has not fulfilled that commitment. • Regarding the activities associated with the technical closure of the landfill, a report containing a compliance schedule was submitted in 2022, but it is evident that the Municipalidad has not followed up on it. Likewise, the requirements of Article 38 of the Reglamento sobre Rellenos sanitarios have not been met. • The transfer center under assessment currently lacks the sanitary operating permit (permiso sanitario de funcionamiento) issued by this Ministry of Health, which, under the Reglamento de Permisos de Funcionamiento, would require this institution to issue an order closing the operation. However, Ministerial Directive N° DM-RM-4805-2014 provides as follows: “…that when grounds exist for closing public operations and establishments, the case must be referred to the highest authority for a determination…because of this, and based on the fact that the specific circumstances of each individual case must be analyzed by those who have conducted the proceeding…initially by the Local Level and then referred to the Regional Directorates for the technical, legal, and social analysis necessary to make the best decision for the sake of Public Health and the well-being and safety of the population…this begins with an assessment at the local level by the Dirección de Área Rectora de Salud, which orders the corresponding inspection and, if instances of noncompliance are identified, authorizes the issuance of the health order (orden sanitaria) and grants a period for compliance according to the complexity of the deficiencies found.
If these orders are not complied with, the local level must analyze whether closure of the establishment should be recommended, based on the need to safeguard public health and the safety of the inhabitants. In view of the foregoing, a health order will be issued requiring the Municipalidad de San Ramón to submit to this Área Rectora de Salud a remedial plan addressing all instances of noncompliance identified in this report.” IV. Based on (sic) the foregoing, health order OS-SR-R-160-2023) is issued to the Mayor of the Municipalidad de San Ramón, Nixon Ureña Guillén, containing the following directives: • Submit to the Área Rectora de Salud a remedial plan that includes all improvements, modifications, and works necessary to complete the technical closure of the garbage landfill located at Dirección2220. This plan must prioritize the provision of potable water to workers. • Apply for the sanitary operating permit for the waste transfer center administered by the Municipalidad de San Ramón. • Comply with the periodic submission of progress reports on the closure works and laboratory analyses, quarterly for the landfill closure works and semiannually for the monitoring wells. • Ensure that the Transfer Station (Estación de transferencia) complies with the maximum permitted limits for atmospheric emissions, wastewater discharges, noise, and vibrations, in accordance with current regulations.
In addition, it must have a first-aid kit, strategically located fire extinguishers, and wildlife-control programs. IN SUMMARY: The petition for constitutional relief (recurso de amparo) may be filed for as long as the violation of fundamental rights persists and for up to two months after its direct effects cease.
In this case, the health authorities had already taken specific and timely measures, such as inspections and a health order (orden sanitaria), to address the alleged violation. Their actions demonstrate commitment and rule out any omission. It is premature to assert that the constitutional rights of the protected party (amparado) are being or will be violated, since the administrative proceeding (procedimiento administrativo) is ongoing. I request that the Honorable Justices consider the context and the authorities’ efforts before determining whether any violation has occurred (…) Based on the foregoing factual and legal considerations, I respectfully request that this Honorable Chamber declare the present constitutional protection proceeding (recurso de amparo), filed by Mr. [Nombre317 001], WITHOUT MERIT. First, it is important to emphasize that the competent health authorities had already taken measures regarding the reported situation.
In particular, inspections had been initiated and a specific health order had been issued to address the matter in question. These actions demonstrate that the authorities were aware of the situation and were taking the measures necessary to address the alleged violation of fundamental rights. Second, the fact that the administrative proceeding is ongoing indicates that the competent authority is taking the necessary steps to investigate and resolve the reported situation. There is no evidence of any omission by the health authorities, as they are fully exercising their powers and authority to address the matter.”
Justice Rueda Leal drafts the opinion; and,
Considering:
Before analyzing the merits of the matter, it must be clarified that, since judgment no. 2008-02545, issued at 08:55 on February 22, 2008, this Chamber has referred to the contentious-administrative jurisdiction those matters in which it is disputed whether the Public Administration complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, for issuing a final administrative act resolving an administrative proceeding—initiated on its own motion or at the request of a party—or for hearing the corresponding administrative appeals. However, it has also recognized exceptions to the foregoing, as in this case, since the grievance concerns an environmental complaint that allegedly was not resolved within a reasonable period. In this type of matter, constitutional case law has deemed constitutional review appropriate, and the sub judice matter will therefore be decided.
Moreover, in this case, a certification signed on June 20, 2023, by the acting secretary and judicial technician 3, both of the Sala Constitucional, stated that there was no record that, between June 14 and June 16, 2023, the director of the Área de Salud de San Ramón of the Ministry of Health had submitted any document in order to provide the report requested by this Court. Nevertheless, in a written submission added to the digital case file on June 15, 2023, Keylor Valenciano Vargas, in his capacity as medical director of the Área de Salud de San Ramón of the Caja Costarricense de Seguro Social, clarified that the order admitting this amparo proceeding had been served on the CCSS, even though the respondent is the Área Rectora de Salud de San Ramón of the Ministry of Health. As a result, on July 4, 2023, the Court served the aforementioned Ministry with the order issued by the Presidency of the Chamber at 14:45 on June 7, 2023; consequently, the aforementioned certification dated June 20, 2023, is set aside.
Furthermore, in a written submission incorporated into the digital case file on July 10, 2023, Nombre10387 states, “in my capacity as concession holder of the Right to the Spring (Derecho a la Naciente), which is located within the property where we live, with all due respect, and in these proceedings I join the petition in its entirety as a person directly affected by the severe pollution that has been occurring for many years without any regulation.” In this regard, section 34 of the Constitutional Jurisdiction Law establishes that anyone with a legitimate interest in the outcome of the proceedings may participate as an interested third party (coadyuvante). Consequently, given that in this case the Court finds that Nombre10387 has a legitimate interest in the outcome of the proceedings because she allegedly holds a concession for a spring (naciente) on the property at issue in this petition, the request to participate as an interested third party is granted.
The petitioner alleges that his property adjoins an open-air dumpsite operated by the Municipalidad de San Ramón, which causes environmental and noise pollution. He states that on January 6, 2023, he filed a complaint with the local government of San Ramón, requesting the technical closure (cierre técnico) of that dumpsite because of the improper treatment of the waste and the existing pollution, as well as the problem involving the spring, but he did not receive a favorable response. He alleges that on April 28, 2023, he filed a complaint with the Área de Salud de San Ramón of the Ministerio de Salud; however, to date, it has neither conducted the inspection he requested nor provided the requested information.
The following facts are deemed duly established and relevant to the decision in this matter:
“1. Submit to this Área Rectora de Salud, for review and approval, a remediation plan that includes all improvements, modifications, and works to be undertaken to complete the technical closure of the garbage dump that operated on the property located at Dirección2220 . As a priority, this plan must include the provision of potable water to workers. 2. Apply for the health operating permit for the waste transfer center administered by the Municipalidad de San Ramón. 3. Submit to this Ministerio de Salud progress reports on the closure works and laboratory analyses conducted quarterly on the landfill closure works and semiannually on the monitoring wells. 4. The transfer station must have: a. Systems that ensure compliance with the applicable maximum permissible limits for atmospheric emissions, wastewater discharges, noise, and vibrations, in accordance with current regulations. b. A labeled first-aid kit located in a clean, dry place and protected from environmental changes that may affect the medications.
Their condition and expiration dates must be verified. c. Fire extinguishers, in a quantity and of a type appropriate to the fire load, strategically located within the facility. d. Ongoing programs for controlling harmful fauna, which must include, at a minimum, the products used for fumigation and the dates on which fumigation was performed. e. The unloading area must have a roof covering the hopper or opening and the collection vehicle in the unloading area. The roof must be at least 6 meters high, and each unloading lane must be at least 3 meters wide. f. The hopper or opening must have a barrier to prevent collection vehicles from falling into it when approaching to unload. g. The sanitary facilities must have floors and walls made of smooth, impermeable material that facilitates cleaning and must be equipped with toilet paper, hand soap, paper towels, or a mechanical hand-drying system.” That submission was served on the mayor of San Ramón on June 23, 2023. (See documentary evidence).
“In response to complaint D-SR-131-2023, filed by you with this Área Rectora de Salud, Licda. Rosa María Chaves Jiménez is assigned responsibility for handling the complaint, which raises the issue related to the operation of a ‘garbage dumpsite’ owned by the Municipalidad de San Ramón. It is noted that an inspection visit was conducted on June 13, 2023, resulting in technical report MSDARSSR-RS-0589-2023 and health order OS-SR-R-160-2023, which states: (…) The outcome will subsequently be reported in accordance with health order OS-SR-127-2023. Regarding the submissions filed on June 15 and 29, 2023, you are advised that a new visit has been scheduled for Wednesday, July 05, 2023.” (See documentary evidence).
“Before addressing the assessment results, it is important to note that all matters related to irregularities in the operation of the transfer center and the technical closure works at the former controlled landfill were addressed in official letter MS-DARSSR-RS-0589-2023 dated June 15, 2023, and health order OS-SR-R-160-2023. In addressing complaint SR-131-2023, prior coordination was undertaken with Mr. [Nombre317 001], and an initial assessment was conducted on June 13 of this year to identify, from a health perspective, the nuisances affecting him on his property. It is therefore untrue that the matter was not coordinated with him in advance; the spring was inspected while accompanied by him and his son, Nombre10386 .
During the visit conducted on July 5, 2023, we were accompanied by Carlos Abarca Mora, identification card CED5145, a municipal employee; José Luis Jiménez Castrillo, who identified himself as the complainant’s attorney; [Nombre317 001], the complainant; and Nombre10386 , the complainant’s son.
All matters raised in complaint SR-131-2023 were assessed, yielding the same results described in official letter MS-DARSSR-RS-0589-2023 dated June 15, 2023. (…)
Additionally, the leachate-management ponds, the areas where technical closure works are underway, the guard-booth areas, the office area, and the dining area were assessed; these had likewise been assessed on June 14 of this year.
Those accompanying the visit were informed that all identified deficiencies had been set forth in health order N° OS-SR-R-160-2023, which was served on Mr. Nixon Ureña Guillen on June 23 of this year.
At the request of this Área Rectora de Salud, the Municipalidad de San Ramón provided evidence of immediate actions taken to eliminate leachate seepage into the project’s storm-sewer system.
It also submitted a document entitled REMEDIATION PLAN FOR THE TECHNICAL CLOSURE OF THE MUNICIPAL LANDFILL AND THE OPERATION OF THE ORDINARY SOLID-WASTE TRANSFER STATION, which is under review by this Área Rectora de Salud (document attached).
An application for an operating permit for the transfer center was also submitted and is being processed for approval or denial.” (See documentary evidence).
With respect to this issue, in judgment no. PHO1917 issued at 9:20 a.m. on September 23, 2022, this Court stated:
“Concerning the nature of the grievances alleged in the matter at hand, this Court has repeatedly ruled on the right to a healthy and ecologically balanced environment. For example, in judgment no. 2021024807 issued at 9:20 a.m. on November 5, 2021, this Chamber stated:
“On numerous occasions, the case law of this Chamber (Sala) has emphasized that the right to a healthy and ecologically balanced environment is recognized at both the constitutional and international treaty levels. It has likewise indicated that the effective protection of that right requires resources to be used rationally, in which context the State and the general public must act in accordance with the principles governing environmental matters. In this regard, specialized legal scholarship has stated that the prevention principle (principio preventivo) requires that, when there is certainty regarding possible environmental harm, the harmful activity must be prohibited, restricted, or made subject to compliance with certain requirements. In general, this principle applies when risks are clearly defined and identified as at least probable; likewise, the principle is useful when there are no technical reports or administrative permits guaranteeing the sustainability of an activity, but sufficient grounds exist to anticipate potential adverse impacts.
The precautionary principle (principio precautorio), on the other hand, provides that where there is a threat of serious and irreversible harm, lack of absolute scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation. It follows from the foregoing that the principle is based on reasonable scientific uncertainty coupled with the threat of serious and irreversible environmental harm. In general terms, a relevant distinction between the prevention principle and the precautionary principle lies in the level of knowledge and certainty concerning the risks posed by an activity or project. Whereas such certainty exists under the former, the latter involves a state of doubt arising from scientific information or technical studies. Accordingly, the Costa Rican State is required to adopt measures that guarantee the effective defense and preservation of the environment in accordance with those principles.
This objective obligation does not, however, inevitably entail a subjective right of individuals to demand, through judicial bodies, that a particular measure be taken, but it does entail a right to the adoption of measures suitable for protecting that right when authorities—or natural or legal persons—act with manifest negligence, in accordance with the recognized theory of the horizontal effect of fundamental rights (teoría de la eficacia horizontal de los derechos fundamentales; Drittwirkung der Menschenrechte), among whose procedural manifestations is the amparo proceeding (amparo) against private-law persons.
It is also important to emphasize that the Inter-American Court of Human Rights, in Advisory Opinion OC-23/17 of 15 de noviembre de 2017, addressed State obligations concerning the environment in order to safeguard the human rights enshrined in the American Convention on Human Rights.
In that opinion, the Court recognized the interrelationship between environmental protection and the realization of other rights, insofar as environmental degradation affects the effective enjoyment and exercise of human rights. In this regard, it stated:
“47. This Court has recognized the existence of an undeniable relationship between environmental protection and the realization of other human rights, insofar as environmental degradation and the adverse effects of climate change affect the effective enjoyment of human rights. Likewise, the preamble to the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (hereinafter, the ‘Protocol of San Salvador’) emphasizes the close relationship between the observance of economic, social and cultural rights—which include the right to a healthy environment—and that of civil and political rights, and indicates that the different categories of rights constitute an indivisible whole grounded in recognition of the dignity of the human person and therefore require permanent protection and promotion in order to ensure their full realization, and that the violation of some rights can never be justified for the sake of realizing others (…)
49. For its part, the Inter-American Commission has emphasized that several fundamental rights require, as a necessary precondition for their exercise, a minimum level of environmental quality and are profoundly affected by the degradation of natural resources. Similarly, the OAS General Assembly has recognized the close relationship between environmental protection and human rights (supra para. 22) and emphasized that climate change has adverse effects on the enjoyment of human rights. 50. At the European level, the European Court of Human Rights has recognized that severe environmental degradation can affect an individual’s well-being and, consequently, result in violations of individual rights, such as the rights to life, respect for private and family life68, and private property. Similarly, the African Commission on Human and Peoples’ Rights has indicated that the right to a ‘generally satisfactory environment favorable to development’ is closely related to economic and social rights, insofar as the environment affects an individual’s quality of life and security (…) 52.
Furthermore, international law broadly recognizes the interdependent relationship between environmental protection, sustainable development, and human rights. This interrelationship has been affirmed since the Stockholm Declaration on the Human Environment (hereinafter, the ‘Stockholm Declaration’), which established that ‘[e]conomic and social development is essential for ensuring a favorable living and working environment for man and for creating conditions on Earth that are necessary for improving the quality of life,’ affirming the need to balance development with protection of the human environment. Subsequently, in the Rio Declaration on Environment and Development (hereinafter, the ‘Rio Declaration’), the States recognized that ‘[h]uman beings are at the centre of concerns for sustainable development’ and, at the same time, emphasized that ‘[i]n order to achieve sustainable development, environmental protection shall constitute an integral part of the development process.’ Building on the foregoing, the Johannesburg Declaration on Sustainable Development established the three pillars of sustainable development: economic development, social development, and environmental protection.
Likewise, in the corresponding Plan of Implementation of the World Summit on Sustainable Development, the States recognized that consideration should be given to the possible relationship between the environment and human rights, including the right to development. 53. Moreover, in adopting the 2030 Agenda for Sustainable Development, the United Nations General Assembly recognized that the realization of human rights for all persons depends on achieving the three dimensions of sustainable development: economic, social, and environmental. Similarly, several instruments within the inter-American system have referred to environmental protection and sustainable development, such as the Inter-American Democratic Charter, which provides that ‘[t]he exercise of democracy promotes the preservation and sound management of the environment’; consequently, ‘[i]t is essential that the states of the Hemisphere implement policies and strategies to protect the environment, including application of various treaties and conventions, to achieve sustainable development for the benefit of future generations’ (…) 55.
As a consequence of the close connection between environmental protection, sustainable development, and human rights (supra paras. 47 to 55), currently (i) multiple human-rights protection systems recognize the right to a healthy environment as a right in itself, particularly the inter-American human-rights system, while there is no doubt that (ii) many other human rights are vulnerable to environmental degradation; all of this entails a series of environmental obligations for States in order to fulfill their obligations to respect and guarantee these rights. Indeed, another consequence of the interdependence and indivisibility of human rights and environmental protection is that, when determining these State obligations, the Court may draw upon the principles, rights, and obligations of international environmental law, which, as part of the international corpus juris, contribute decisively to defining the scope of the obligations arising from the American Convention in this area (supra paras. 43 to 45) (…) 59.
The human right to a healthy environment has been understood as a right with both individual and collective dimensions. In its collective dimension, the right to a healthy environment constitutes a universal interest owed to both present and future generations. The right to a healthy environment also has an individual dimension, insofar as its violation may have direct or indirect repercussions on individuals because of its connection with other rights, such as the rights to health, personal integrity, and life, among others. Environmental degradation can cause irreparable harm to human beings; therefore, a healthy environment is a fundamental right for the existence of humankind.”.
This interrelationship between the environment and the enjoyment of other human rights has also been recognized by the United Nations Human Rights Council, which, in resolution A/HRC/RES/46/7, adopted on 23 de marzo de 2021 at its 46° session, stated:
“Also recognizing that sustainable development and environmental protection, including the protection of ecosystems, contribute to human well-being and the enjoyment of human rights, particularly the rights to life, to the enjoyment of the highest attainable standard of physical and mental health, to an adequate standard of living, to adequate food, to safe drinking water and sanitation, and to housing, as well as cultural rights.”.
More recently, in resolution A/HRC/RES/48/13, adopted on 8 de octubre de 2021, that Council stated:
“(…) Recognizing that sustainable development, in its three dimensions (social, economic and environmental), and environmental protection, including the protection of ecosystems, contribute to and promote human well-being and the enjoyment of human rights, including the enjoyment of the rights to life, to the highest attainable standard of physical and mental health, to an adequate standard of living, to adequate food, to housing, to safe drinking water and sanitation, and to participation in cultural life, for present and future generations (…)
Recognizing also that environmental degradation, climate change, and unsustainable development constitute some of the most pressing and serious threats to the ability of present and future generations to enjoy human rights, including the right to life (…)
Recognizing the importance of a clean, healthy, and sustainable environment as essential to the enjoyment of all human rights (…)
1. Recognizes the right to a clean, healthy, and sustainable environment as a human right that is important for the enjoyment of human rights; 2. Notes that the right to a clean, healthy, and sustainable environment is related to other rights and existing international law (…)”. (Emphasis not in the original).
Thus, the particular relevance of the fundamental right to a healthy and ecologically balanced environment is reflected, the defense of which goes beyond protecting this constitutional interest in itself, since its preservation is an essential factor in effectively safeguarding other fundamental interests of human beings (such as life, health, property, and equality); consequently, if the former is not protected, the latter cannot be effectively safeguarded.
Moreover, in the aforementioned opinion, the Inter-American Court of Human Rights recognized the right to a healthy environment as an autonomous right capable of protection independently of any risk of harm to individual persons. In this regard, it held:
“62. This Court considers it important to emphasize that the right to a healthy environment as an autonomous right, unlike other rights, protects components of the environment, such as forests, rivers, seas, and others, as legally protected interests in themselves, even in the absence of certainty or evidence regarding risks to individual persons. This entails protecting nature and the environment not only because of their connection to their usefulness to human beings or because of the effects that their degradation could have on other individual rights, such as health, life, or personal integrity, but also because of their importance to the other living organisms with which the planet is shared, which are likewise deserving of protection in their own right. In this regard, the Court notes a trend toward recognizing legal personality and, consequently, rights for nature, not only in judicial decisions but even in constitutional legal systems. 63. Thus, the right to a healthy environment as an autonomous right differs from the environmental content arising from the protection of other rights, such as the right to life or the right to personal integrity.”. (Emphasis not in the original).
This position was adopted in the judgment of 6 de febrero de 2020 concerning the case “Comunidades Indígenas miembros de la Asociación Lhaka Honhat (Nuestra Tierra) vs. Argentina,” in which, moving beyond an anthropocentric approach, the Inter-American Court of Human Rights states that the right to a healthy environment, in addition to being fundamental to the very existence of human beings, is an autonomous and universal right, such that the protection of various components of the environment (such as forests, seas, rivers, and others) constitutes a legally protected interest in itself. In the words of the Inter-American Court of Human Rights: “This entails protecting nature,” not only because of its “usefulness” or “effects” in relation to human beings, “but also because of its importance to the other living organisms with which the planet is shared.” Given the significance of this statement, it is appropriate to reproduce this section of the aforementioned decision:
“203. The Court has already addressed the content and scope of this right, taking into account various relevant provisions, in its Advisory Opinion OC-23/17, to which it refers. On that occasion, it stated that the right to a healthy environment ‘constitutes a universal interest’ and ‘is a fundamental right for the existence of humankind,’ and that ‘as an autonomous right […] it protects components of the […] environment, such as forests, seas, rivers, and others, as legally protected interests in themselves, even in the absence of certainty or evidence regarding risks to individual persons. This entails protecting nature,’ not only because of its ‘usefulness’ or ‘effects’ in relation to human beings, ‘but also because of its importance to the other living organisms with which the planet is shared.’ The foregoing does not, of course, preclude the possibility that other human rights may be violated as a consequence of environmental harm.”. (Emphasis not in the original).
Based on the foregoing, this Chamber, as guarantor of fundamental rights, must ensure compliance with treaty-based and constitutional obligations, which compel the State not only to recognize the rights enshrined therein but also to impose the legal measures required to safeguard them” (emphasis in the original).
In addition, the United Nations General Assembly recently adopted resolution no. A/RES/76/1-A/RES/76/300 of 28 de julio de 2022, which stated:
“1. Recognizes the right to a clean, healthy, and sustainable environment as a human right; 2. Notes that the right to a clean, healthy, and sustainable environment is related to other rights and existing international law; 3. Affirms that promoting the human right to a clean, healthy, and sustainable environment requires the full implementation of multilateral environmental agreements in accordance with the principles of international environmental law; 4. Calls upon States, international organizations, businesses, and other relevant stakeholders to adopt policies, enhance international cooperation, strengthen capacity-building, and continue sharing good practices in order to intensify efforts to ensure a clean, healthy, and sustainable environment for all”.
This resolution is the formal expression of the will of the principal deliberative, policymaking, and representative body of the United Nations. It therefore constitutes a universal political commitment that must be regarded as a source of soft law of the utmost relevance.
Specifically, resolution no. A/RES/76/1-A/RES/76/300 affirms that the right to a healthy and ecologically balanced environment is a human right. In large measure, this contributes to its codification, resulting in its technical understanding as a “fundamental right.” It also reinforces the notion that environmental protection is an “autonomous” human right—that is, one that has value in itself—such that, on the one hand, it has its own conceptual existence, distinct from the environmental content that undoubtedly arises from the protection of other rights (such as life or health), and, on the other, the subject of its protection extends beyond human beings, since it safeguards the various components of nature because of their importance in preserving the existence of living organisms in general, irrespective of their usefulness to human beings.
It also reiterates and thereby strengthens the position that the right to a healthy and ecologically balanced environment is linked to other human rights, which means that its violation may lead to infringements of health, life, and democratic sustainable development, to cite only a few examples. The foregoing gives the right at issue particularly significant legal meaning.
In addition, the UN General Assembly provides that protecting the right to a healthy and ecologically balanced environment requires the full implementation of treaty-based environmental rights in accordance with the principles of international environmental law. It follows from the foregoing that this right must necessarily be included within this Chamber’s judicial review of constitutionality (control jurisdiccional de constitucionalidad).
Lastly, in harmony with the recognized theory of the horizontal effect of fundamental rights (eficacia horizontal de los derechos fundamentales; Drittwirkung der Menschenrechte), resolution no. A/RES/76/1-A/RES/76/300 provides that the obligation to safeguard the environment extends beyond States to international organizations, businesses, and other stakeholders, the latter term encompassing human beings in general. It is precisely in this sense that the Ley de la Jurisdicción Constitucional provides for the remedy of amparo (amparo) against private-law parties.
In sum, under the conceptual framework explained above, this Constitutional Court, as guarantor of fundamental rights, must ensure compliance with the treaty-based and constitutional commitments that impose upon the Costa Rican State and society in general not only the obligation to recognize the rights, principles, and values relating to environmental matters, but also the obligation to implement all measures and actions necessary to ensure their effective protection” (emphasis in the original).
In the case at bar (sub lite), the petitioner alleges that his property borders an open-air dump (botadero a cielo abierto) operated by the Municipalidad de San Ramón, which causes environmental and noise pollution (contaminación ambiental y sónica). He states that on 6 de enero de 2023 he filed a complaint with the local government of San Ramón, requesting the technical closure (cierre técnico) of that dump because of the improper treatment of the waste, the existing pollution, and the problem involving the spring (naciente), but he did not receive a favorable response. He alleges that on 28 de abril de 2023 he filed a complaint with the Área de Salud de San Ramón del Ministerio de Salud; however, to date, it has neither conducted the inspection he requested nor provided the information sought.
The Chamber finds that, on 6 de enero de 2023, the protected party (amparado) filed a complaint with the local government of San Ramón, which was received on 20 de enero de 2023 and addressed through official letter MSR-AM-GM-DDU-SMA-016-2023, whereby “several questions raised (sic) by Mr. [Nombre317 001] concerning the management of solid waste carried out at the municipal transfer center were rebutted.” Furthermore, on 28 de abril de 2023, the petitioner filed complaint D-SR131-2023 with the Ministerio de Salud, alleging that the Municipalidad de San Ramón operates a garbage dump that affects, among other things, a water spring located on his property. He further reported that: i) the workers employed there do not have access to drinking water and therefore drink from a contaminated well; ii) no treatment ponds exist, and the liquids and acids released by the waste flow into a stream that receives overflow from the spring located on his property and subsequently runs into the río Barranca; iii) there are no gutters or drainage systems; iv) there are no chimneys; and v) the Municipalidad de San Ramón dumps the waste merely 60 meters from the water spring that supplies his family.
That filing requested: i) an inspection of the reported site; ii) a copy of the permits issued by the Ministerio de Salud in connection with the operation of that site, as well as a copy of the administrative case file (expediente administrativo); iii) a copy of the monitoring logs; and iv) closure of the dump.
The evidence shows that, on 14 de junio de 2023, the Ministerio de Salud inspected the reported site. Likewise, on 15 de junio de 2023, the petitioner filed a written submission with the Ministerio de Salud expressing his dissatisfaction with the inspection conducted at the reported site and requesting that a new inspection be performed. Subsequently, on 22 de junio de 2023, the Ministerio de Salud issued health order (orden sanitaria) OS-SR-R-160-2023, granting the mayor of San Ramón a period of 20 business days to: “1. Submit to this Área Rectora de Salud, for its respective review and approval, a remediation plan (plan remedial) that includes all improvements, modifications, and works to be carried out to achieve the technical closure (cierre técnico) of the garbage dump (vertedero de basura) that operated on the property located at Dirección2220. This plan must prioritize the provision of drinking water to workers. 2.
Apply for the sanitary operating permit (permiso sanitario de funcionamiento) for the waste transfer center (centro de transferencia de residuos) operated by the Municipalidad de San Ramón. 3. Submit to this Ministerio de Salud progress reports on the closure works and laboratory analyses conducted quarterly on the dump-closure works and semiannually on the monitoring wells. 4. The transfer station (Estación de transferencia) must have: a. Systems that ensure compliance with the applicable maximum permissible limits for atmospheric emissions, wastewater discharges, noise, and vibrations, in accordance with current regulations. b. A labeled first-aid kit located in a clean, dry place and protected from environmental changes that affect medications. Their condition and expiration dates must be checked. c. Fire extinguishers of a quantity and type appropriate to the fire load, strategically located within the facility. d. Ongoing pest-control programs that record, at a minimum, the products used for fumigation and the dates on which it was performed. e. The unloading area shall have a roof covering the hopper or trench and the collection vehicle in the unloading area.
The roof shall be at least 6 meters high, and each unloading lane shall be at least 3 meters wide. f. The hopper or trench must have a barrier to prevent collection vehicles from falling into it as they approach to unload. g. The sanitary facilities must have floors and walls made of smooth, waterproof material that facilitates cleaning and must be equipped with toilet paper, hand soap, paper towels, or a mechanized hand-drying system.” That document was served on the mayor of San Ramón on 23 de junio de 2023.
Additionally, on 29 de junio de 2023, the appellant filed a submission with the respondent ministry stating, among other things, that garbage had remained uncollected and foul odors had been present from 27 al 29 de junio de 2023. By official letter MS-DRRSCO-DARS-SR-0942-2023 of 3 de julio de 2023, the Ministerio de Salud informed the appellant: “In response to complaint D-SR-131-2023, filed by you with this Área Rectora de Salud, Licda. Rosa María Chaves Jiménez is assigned responsibility for handling the complaint, which raises the problem associated with the operation of a ‘garbage dump,’ owned by the Municipalidad de San Ramón. You are advised that an inspection visit was conducted on 13 de junio de 2023, resulting in the issuance of technical report MSDARSSR-RS-0589-2023 and health order OS-SR-R-160-2023, which states: (…) You will subsequently be informed of the outcome in accordance with the directives contained in health order OS-SR-127-2023.
With respect to the written submissions filed on 15 y 29 de junio de 2023, you are advised that a new visit has been scheduled for miércoles 05 de julio de 2023.” On 5 de julio de 2023, the Ministerio de Salud inspected the reported site in the appellant’s company. In document MS-DARSSR-RS-706-2023 of 18 de julio de 2023, the Área Rectora de Salud de San Ramón stated: “Before addressing the results of the assessment, it is important to mention that all matters related to irregularities in the operation of the transfer center and the technical-closure works at the former controlled dump (vertedero controlado) were addressed in official letter MS-DARSSR-RS-0589-2023 dated 15 de junio del 2023 and health order OS-SR-R-160-2023. For purposes of addressing complaint SR-131-2023, prior coordination was undertaken with Mr. [Nombre317 001], and an initial assessment was conducted on 13 de junio del presente año to identify, from a health standpoint, the nuisances affecting him within his property.
Therefore, it is untrue that the matter was not coordinated with him beforehand, and the spring (naciente) was examined while accompanied by him and his son, Nombre10386. During the visit conducted on 5 de julio del 2023, we were accompanied by Carlos Abarca Mora, identification card CED5145, a municipal employee; José Luis Jiménez Castrillo, who identified himself as the complainant’s attorney; [Nombre317 001], the complainant; and Nombre10386, the complainant’s son. All matters mentioned in complaint SR-131-2023 were assessed, yielding the same results described in official letter MS-DARSSR-RS-0589-2023, dated 15 de junio del 2023. (…) Additionally, the leachate-management ponds, the areas where technical-closure works are being performed, the guard-booth area, office area, and dining area were assessed; these had likewise been assessed on 14 de junio del presente año. Those accompanying the visit were informed that all identified deficiencies were included in health order N° OS-SR-R-160-2023, which was served on Mr.
Nixon Ureña Guillen on 23 de junio del presente año. At the request of this Área Rectora de Salud, the Municipalidad de San Ramón provided evidence of immediate actions taken to eliminate the seepage of leachate (lixiviados) into the project’s stormwater sewer system (sistema de alcantarillado pluvial). It also submitted a document entitled REMEDIATION PLAN FOR THE TECHNICAL CLOSURE OF THE MUNICIPAL DUMP AND THE OPERATION OF THE ORDINARY SOLID-WASTE TRANSFER STATION, which is currently being evaluated by this Área Rectora de Salud (document attached). An application for an operating permit for the transfer center was also submitted and is being processed for approval or denial” (emphasis added).
Now, regarding the complaint filed on 6 de enero de 2023 with the Municipalidad de San Ramón, the Chamber observes that, although document MSR-AM-GM-DDU-SMA-016-2023 “refuted several questions raised (sic) by Mr. [Nombre317 001] regarding the solid-waste management carried out at the municipal transfer center,” it is no less true that, substantively, the appellant’s allegations were not addressed. This is evidenced by the fact that an inspection conducted by the Ministerio de Salud at the reported site in junio de 2023 confirmed several violations that led to the issuance of health order OS-SR-R-160-2023, which compelled the mayor of San Ramón to: “1. Submit to this Área Rectora de Salud, for its respective review and approval, a remediation plan that includes all improvements, modifications, and works to be carried out to achieve the technical closure of the garbage dump that operated on the property located at Dirección2220.
This plan must prioritize the provision of drinking water to workers. 2. Apply for the sanitary operating permit for the waste transfer center operated by the Municipalidad de San Ramón. 3. Submit to this Ministerio de Salud progress reports on the closure works and laboratory analyses conducted quarterly on the dump-closure works and semiannually on the monitoring wells. 4. The transfer station must have: a. Systems that ensure compliance with the applicable maximum permissible limits for atmospheric emissions, wastewater discharges, noise, and vibrations, in accordance with current regulations. b. A labeled first-aid kit located in a clean, dry place and protected from environmental changes that affect medications. Their condition and expiration dates must be checked. c. Fire extinguishers of a quantity and type appropriate to the fire load, strategically located within the facility. d. Ongoing pest-control programs that record, at a minimum, the products used for fumigation and the dates on which it was performed. e. The unloading area shall have a roof covering the hopper or trench and the collection vehicle in the unloading area.
The roof shall be at least 6 meters high, and each unloading lane shall be at least 3 meters wide. f. The hopper or trench must have a barrier to prevent collection vehicles from falling into it as they approach to unload. g. The sanitary facilities must have floors and walls made of smooth, waterproof material that facilitates cleaning and must be equipped with toilet paper, hand soap, paper towels, or a mechanized hand-drying system.” Accordingly, the appeal is granted with respect to the municipal corporation of San Ramón, as established in the operative portion of this ruling.
VI.On the other hand, in the case under review, it has been established that, on 28 de abril de 2023, the petitioner filed a complaint with the Ministerio de Salud. In this regard, this Court finds that when the appellant applied to this specialized jurisdiction, namely, on 2 de junio de 2023, only slightly more than one month had elapsed since the complaint in question was filed, and therefore the appeal is premature with respect to this grievance. Accordingly, the application for constitutional relief (amparo) is denied as to this issue.
In any event, it has been fully demonstrated in this case that, in response to the complaint in question, the Ministerio de Salud adopted various measures, most notably two inspections of the reported site and the issuance of a health order. Having clarified the foregoing, the petitioner is advised that this Constitutional Court does not have jurisdiction to rule, under the subconstitutional regulations governing the matter and the particular circumstances of the case under review, on the objections raised concerning those inspections, the health order issued by that ministry, or the remediation plan required of the respondent municipal corporation. Nor is it for this specialized Chamber to address the statements concerning the location of the spring that the appellant claims exists on his property. This is because those matters concern ordinary legality and must therefore be resolved before the respondent authority itself or through ordinary judicial proceedings.
VII.Notwithstanding the foregoing, in the case at bar, the Ministerio de Salud is found to have violated the protected party’s fundamental rights by failing to address the requests contained in the complaint of 28 de abril de 2023. It should be recalled that, in that submission, the petitioner requested: i) that the reported site be inspected; ii) that he be provided with a copy of the permits issued by the Ministerio de Salud in connection with the operation of that site, as well as the administrative record (expediente administrativo); iii) that he be provided with a copy of the monitoring logs (bitácoras de monitoreo); and iv) that the dump be closed.
Regarding this matter, note that the requests set forth in items i) and iv) concern the relief sought (pretensiones) in the complaint (denuncia) filed, which was addressed in the preceding recital (considerando) of this ruling; consequently, the allegation is premature. However, the requests set forth in items ii) and iii) constitute requests for information, and therefore do not involve any type of administrative claim (reclamo administrativo), but rather a potential violation of Article 30 of the Constitution. With respect to this type of grievance, the Chamber does not find the remedy for protection of constitutional rights (amparo) to be premature; accordingly, it must determine whether the fundamental rights of the protected party have been violated as alleged.
In this regard, in the matter sub iudice, it is undisputed that the Ministerio de Salud did not address the requests made by the petitioner in items ii) and iii) of the submission dated 28 de abril de 2023, since there is no evidence that any response was provided in that respect. Therefore, the amparo is granted as to these items due to the violation of the right to information.
VIII.NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE (JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA). I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), jurisdiction over the legal dispute lies with the Tribunales de lo Contencioso-Administrativo, rather than with this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is subject to judicial protection through the amparo proceeding (recurso de amparo) established by Article 32 of the Ley de la Jurisdicción Constitucional, in relation to Article 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner considers that the Administration’s material actions, administrative acts (actos administrativos), or response are affecting the petitioner’s fundamental rights.
In my view, the newly enacted legislation does not require this Court to modify its line of precedent (línea jurisprudencial), because, pursuant to section 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes (controversias jurídico-constitucionales) that this Chamber itself has recognized as exceptional cases and that may indeed be heard in this jurisdiction through the constitutional guarantee proceeding of amparo (proceso constitucional de garantía del amparo), in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 at 8:55 hours on 22 de febrero de 2008), jurisdiction lies with the Judges of the administrative-litigation jurisdiction (jurisdicción de lo contencioso-administrativo). All of the foregoing is consistent with section 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Notice is given that any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in Article XXVI of session nro. 27-11 of 22 de agosto de 2011, published in the Boletín Judicial nro. 19 of 26 de enero de 2012, as well as pursuant to the resolution of the Consejo Superior del Poder Judicial approved in Article LXXXI of session nro. 43-12 held on 3 de mayo de 2012.
Por tanto:
With respect to the Municipalidad de San Ramón, the amparo is granted. Nixon Ureña Guillén, Hermelink Chinchilla Corrales, and Allan Artavia Jiménez, in their respective capacities as Mayor, President of the Concejo, and official assigned to the Servicios Municipales Ambientales, both of the Municipalidad de San Ramón, or whoever may hold those offices in their stead, are ordered to undertake the necessary coordination and perform all actions within the scope of their respective authority in order to comply with sanitary order (orden sanitaria) OS-SR-R-160-2023 issued by the Ministerio de Salud on 22 de junio de 2023. With respect to the Ministerio de Salud, the amparo is granted solely as to the failure to respond to items ii) and iii) of the submission made by the petitioner on 28 de abril de 2023. Ana Isabel Rodríguez Sánchez, in her capacity as Director of the Área Rectora de Salud de San Ramón, or whoever may hold that office in her stead, is ordered to undertake the necessary coordination and perform all actions within the scope of her authority so that, within a maximum period of CINCO DÍAS from notification of this judgment, the petitioner’s requests in items ii) and iii) of the submission dated 28 de abril de 2023 are addressed as required by law, namely: ii) to provide a copy of the permits issued by the Ministerio de Salud in connection with the operation of that location, as well as the administrative file (expediente administrativo); and iii) to provide a copy of the monitoring logs (bitácoras de monitoreo), and to notify the petitioner accordingly.
The foregoing is ordered with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that they are required to comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de San Ramón and the State are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) before the administrative-litigation jurisdiction. Justice Castillo Víquez submits a note. In all other respects, the amparo is denied. Let notice be given.

Revisión del Documento Res. Nº PHO7178 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del cuatro de agosto de dos mil veintitres .
Recurso de amparo que se tramita en expediente número 23-012941-0007-CO, interpuesto por [Nombre317 001], cédula de identidad [Valor CED165], contra la MUNICIPALIDAD DE SAN RAMÓN Y EL MINISTERIO DE SALUD.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia nro. 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contenciosa‑administrativa aquellos asuntos, en los que se discute si la Administración Pública ha cumplido o no los plazos fijados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales en los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo ‑instruido de oficio o a instancia de parte‑ o conocer de los recursos administrativos correspondientes. Sin embargo, también ha contemplado casos de excepción a lo anterior, como sucede en la especie, toda vez que el agravio se refiere una denuncia ambiental que, presuntamente, no ha sido resuelto dentro de un plazo razonable. En este tipo de materia, la jurisprudencia constitucional ha estimado procedente la aplicación del control de constitucionalidad, de modo que se procede a resolver el sub iudice.
De otro lado, en la especie, mediante constancia suscrita el 20 de junio de 2023 por la secretaria a. i. y el técnico judicial 3, ambos de la Sala Constitucional, se indicó que no apareció que, entre el 14 y el 16 de junio de 2023, el director del Área de Salud de San Ramón del Ministerio de Salud haya aportado documento alguno, a fin de rendir el informe requerido por este Tribunal. No obstante, por escrito incorporado al expediente digital el 15 de junio de 2023, Keylor Valenciano Vargas, en su condición de director médico del Área de Salud de San Ramón de la Caja Costarricense de Seguro Social aclaró que la resolución de curso de este recurso le fue notificada a la CCSS, pese a que la parte recurrida es el Área Rectora de Salud de San Ramón del Ministerio de Salud. Producto de lo anterior, el Tribunal notificó la resolución de la Presidencia de la Sala de las 14:45 horas del 7 de junio de 2023 al ministerio aludido el 4 de julio de 2023 y, en consecuencia, se deja sin efecto la mencionada constancia fechada 20 de junio de 2023.
Por otra parte, por escrito incorporado al expediente digital el 10 de julio de 2023, Nombre10387 , indica “en calidad de concesionaria del Derecho a la Naciente, que se encuentra dentro de la finca donde convivimos, con todo respeto, y dentro de este recurso me adhiero en todo al mismo como afectada directa producto de la gran contaminación que se viene dando desde hace muchos años, sin ninguna regulación”. Sobre el particular, el ordinal 34 de la Ley de la Jurisdicción Constitucional establece que puede intervenir como coadyuvante en el proceso quien tiene un interés legítimo en su resultado. En consecuencia, dado que en la especie el Tribunal estima que Nombre10387 tiene un interés legítimo en el resultado del proceso al presuntamente tener una concesión de una naciente en la finca objeto de este recurso, se acoge la solicitud de coadyuvancia planteada.
La parte accionante acusa que su propiedad colinda con un botadero a cielo abierto que tiene la Municipalidad de San Ramón, lo que ocasiona contaminación ambiental y sónica. Expone que el 6 de enero de 2023 planteó una queja ante el gobierno local de San Ramón, mediante el que solicitó el cierre técnico de ese basurero por el mal tratamiento que se le da a la basura y por la contaminación existente, así como con el problema con la naciente, pero no recibió una respuesta positiva. Alega que el 28 de abril de 2023 interpuso una denuncia ante el Área de Salud de San Ramón del Ministerio de Salud; sin embargo, a la fecha no han realizado la inspección que solicitó, ni le brindaron la información peticionada.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
“1. Presentar ante esta Área Rectora de Salud, para su respectiva revisión y aprobación, un plan remedial que incluya todas las mejoras, modificaciones y obras a realizar para cumplir con el cierre técnico del vertedero de basura que funcionó en propiedad ubicada en Dirección2220 . Este deberá incluir de manera prioritaria el suministro de agua potable a los trabajadores. 2. Solicitar el permiso sanitario de funcionamiento del centro de transferencia de residuos administrado por la Municipalidad de San Ramón. 3. Cumplir con la presentación ante este Ministerio de Salud del avance de las obras de cierre y los análisis de laboratorio, practicados trimestralmente de las obras de cierre del vertedero y semestralmente de los pozos de monitoreo. 4. La Estación de transferencia deberá contar con: a. Sistemas que garanticen los límites máximos permitidos que les sean aplicables en materia de emisiones a la atmósfera, vertido de aguas residuales, ruido y vibraciones; de acuerdo con la reglamentación vigente. b. Un botiquín de primeros auxilios rotulado y ubicado en un lugar limpio y seco, protegido de los cambios ambientales que afectan a los medicamentos.
Se deberá verificar el estado y fecha de caducidad de estos. c. Extintores, en cantidad y tipo de acuerdo con la carga de fuego; ubicados estratégicamente dentro del establecimiento. d. Programas permanentes para el control de fauna nociva que cuenten como mínimo los productos utilizados en la fumigación y la fecha de estas. e. La zona de descarga contará con techumbre que cubra la tolva o ranura y el vehículo recolector en la zona de descarga. La altura de la techumbre será como mínimo 6 metros y cada carril de descarga deberá tener una anchura mínima de 3 metros. f. La tolva o ranura debe contar con un tope para impedir que los vehículos recolectores puedan caer en ella al aproximarse para la descarga. g. Los servicios sanitarios deben contar con pisos y paredes de material liso e impermeable que faciliten su limpieza, estar equipados con papel higiénico, jabón de manos, toallas de papel o sistema mecanizado de secado de manos”.
Tal memorial fue notificado al alcalde de San Ramón el 23 de junio de 2023. (Ver prueba documental).
“En atención de la denuncia D-SR-131-2023, interpuesta por usted ante esta Área Rectora de Salud, se designa a la Licda. Rosa María Chaves Jiménez la responsabilidad de brindar cobertura a la denuncia, en la que se plantea el problema relacionado son el funcionamiento de un “botadero de basura”, propiedad de la Municipalidad de San Ramón, se indica que se procedió a realizar visita de inspección d día 13 de junio de 2023. emitiéndose el informe técnico MSDARSSR-RS-0589-2023 y la orden sanitaria OS-SR-R-160-2023. en el cual se Indica: (…) Posterior se informará el resultado según lo ordenado en la orden sanitaria OS-SR-127-2023. Con respecto a los escritos presentados el 15 y 29 de junio de 2023 se le indica que se programa una nueva visita para el miércoles 05 de julio de 2023”. (Ver prueba documental).
“Previo a referirse a los resultados de la evaluación, es importante mencionar que todos los puntos relacionados con las irregularidades de operación del centro de transferencia, y de las obras de cierre técnico del antiguo vertedero controlado, fueron contemplados en oficio MS-DARSSR-RS-0589-2023 de fecha 15 de junio del 2023 y orden sanitaria OS-SR-R-160-2023.Para intervención de la denuncia SR-131-2023, se coordinó previamente con el señor [Nombre317 001] y se realizó una primera evaluación en fecha 13 de junio del presente año, con el objetivo de identificar las molestias desde el punto de vista de salud que le afectaban dentro de su propiedad, razón por la cual no es cierto que el asunto no fuese coordinado previamente con él y se conoció la naciente siendo acompañados por su persona y su hijo Nombre10386 .
En la visita realizada el día 5 de julio del 2023 nos acompañaron los señores Carlos Abarca Mora, cédula CED5145, trabajador municipal, José Luis Jiménez Castrillo quien se identifica como abogado del denunciante, [Nombre317 001], denunciante y Nombre10386 , hijo del denunciante.
Se valoran todos los puntos que fueron mencionados en denuncia SR-131-2023, obteniendo los mismos resultados descritos en oficio MS-DARSSR-RS-0589-2023, de fecha 15 de junio del 2023. (…)
Adicionalmente se valoraron las pilas para el manejo de lixiviados, las áreas donde se está realizando obras de cierre técnico, las áreas de casetilla de guarda, área de oficinas, área de comedor, los cuales de la misma manera fueron evaluados el 14 de junio del presente año.
Se les informa a los acompañantes en la visita que todas las deficiencias identificadas fueron planteadas en orden sanitaria N° OS-SR-R-160-2023 la cual fue notificada al Sr. Nixon Ureña Guillen en fecha 23 de junio del presente año.
A solicitud de esta Área Rectora de Salud, la Municipalidad de San Ramón aportó pruebas de acciones inmediatas realizadas para eliminar la filtración de lixiviados al sistema de alcantarillado pluvial del proyecto.
Igualmente presentó documento denominado PLAN REMEDIAL PARA EL CIERRE TÉCNICO DEL VERTEDERO MUNICIPAL Y LA OPERACIÓN DE LA ESTACIÓN DE TRANSFERENCIA DE RESIDUOS SÓLIDOS ORDINARIOS, el cual esté en proceso de evaluación por parte de esta Área Rectora de Salud (se adjunta documento).
Se presentó igualmente solicitud de permiso de funcionamiento para el Centro de transferencia, el cual está en trámite para su aprobación o rechazo”. (Ver prueba documental).
En cuanto a este tema, en la sentencia nro. PHO1917 de las 9:20 horas del 23 de setiembre de 2022, este Tribunal señaló:
“Concerniente a la naturaleza de los agravios acusados en el sub lite, este Tribunal se ha pronunciado en reiteradas ocasiones respecto al derecho a un ambiente sano y ecológicamente equilibrado. Verbigracia, en la sentencia n.° 2021024807 de las 9:20 horas del 5 de noviembre de 2021, esta Cámara señaló:
“En reiteradas ocasiones, la jurisprudencia de esta Sala ha subrayado que el derecho a un ambiente sano y ecológicamente equilibrado se encuentra reconocido tanto a nivel constitucional como convencional. Asimismo, se ha indicado que la protección efectiva a ese derecho requiere que los recursos sean utilizados de manera racional, contexto en que el Estado y la ciudadanía en general deben actuar según los principios que rigen la materia ambiental. En este orden de ideas, la doctrina especializada ha señalado que el principio preventivo demanda que, cuando haya certeza de posibles daños al ambiente, la actividad afectante deba ser prohibida, limitada, o condicionada al cumplimiento de ciertos requerimientos. En general, este principio aplica cuando existen riesgos claramente definidos e identificados al menos como probables; asimismo, tal principio resulta útil cuando no existen informes técnicos o permisos administrativos que garanticen la sostenibilidad de una actividad, pero hay elementos suficientes para prever eventuales impactos negativos.
Por otra parte, el principio precautorio señala que, cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente. De lo anterior, se advierte que el principio parte de una incertidumbre científica razonable en conjunto con la amenaza de un daño ambiental grave e irreversible. En términos generales, una diferencia relevante entre el principio preventivo y el precautorio radica en el nivel de conocimiento y certeza de los riesgos que una actividad u obra provoque. Mientras que en el primero existe tal certeza, en el segundo lo que se advierte es un estado de duda resultado de informaciones científicas o estudios técnicos. Así, el Estado costarricense se encuentra obligado a adoptar las medidas que garanticen la defensa y preservación efectiva del ambiente conforme a tales principios.
Ahora, tal obligación objetiva no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los órganos jurisdiccionales, que se tome una medida determinada, pero sí a que se adopten las que sean idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades, o bien, de personas físicas y jurídicas, conforme la reconocida teoría de la eficacia horizontal de los derechos fundamentales (Drittwirkung der Menschenrechte), entre cuyas manifestaciones procesales se encuentra el amparo contra sujetos de derecho privado.
Interesa también resaltar que la Corte Interamericana de Derechos Humanos, en la Opinión Consultiva OC-23/17 de 15 de noviembre de 2017, desarrolló lo atinente a las obligaciones estatales en relación con el medio ambiente, en aras de la salvaguardia a los derechos humanos consagrados en la Convención Americana sobre Derechos Humanos.
En esa opinión, la Corte reconoció la interrelación entre la protección del medio ambiente y la realización de otros derechos, en tanto la degradación ambiental afecta el goce y desarrollo efectivo de los derechos humanos. En tal sentido, señaló:
“47. Esta Corte ha reconocido la existencia de una relación innegable entre la protección del medio ambiente y la realización de otros derechos humanos, en tanto la degradación ambiental y los efectos adversos del cambio climático afectan el goce efectivo de los derechos humanos. Asimismo, el preámbulo del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales (en adelante “Protocolo de San Salvador”), resalta la estrecha relación entre la vigencia de los derechos económicos, sociales y culturales -que incluye el derecho a un medio ambiente sano - y la de los derechos civiles y políticos, e indica que las diferentes categorías de derechos constituyen un todo indisoluble que encuentra su base en el reconocimiento de la dignidad de la persona humana, por lo cual exigen una tutela y promoción permanente con el objeto de lograr su vigencia plena, sin que jamás pueda justificarse la violación de unos en aras de la realización de otros (…)
49. Por su parte, la Comisión Interamericana ha resaltado que varios derechos de rango fundamental requieren, como una precondición necesaria para su ejercicio, una calidad medioambiental mínima, y se ven afectados en forma profunda por la degradación de los recursos naturales. En el mismo sentido, la Asamblea General de la OEA ha reconocido la estrecha relación entre la protección al medio ambiente y los derechos humanos (supra párr. 22) y destacado que el cambio climático produce efectos adversos en el disfrute de los derechos humanos. 50. En el ámbito europeo, el Tribunal Europeo de Derechos Humanos ha reconocido que la degradación severa del medio ambiente puede afectar el bienestar del individuo y, como consecuencia, generar violaciones a los derechos de las personas, tales como los derechos a la vida, al respeto a la vida privada y familiar68 y a la propiedad privada. De manera similar, la Comisión Africana de Derechos Humanos y de los Pueblos ha indicado que el derecho a un “medio ambiente general satisfactorio, favorable al desarrollo” está estrechamente relacionado con los derechos económicos y sociales en la medida en que el medio ambiente afecta la calidad de vida y la seguridad del individuo (…) 52.
Por otra parte, existe un amplio reconocimiento en el derecho internacional sobre la relación interdependiente entre la protección al medio ambiente, el desarrollo sostenible y los derechos humanos. Dicha interrelación se ha afirmado desde la Declaración de Estocolmo sobre el Medio Ambiente Humano (en adelante “Declaración de Estocolmo”), donde se estableció que “[e]l desarrollo económico y social es indispensable para asegurar al hombre un ambiente de vida y trabajo favorable y crear en la Tierra las condiciones necesarias para mejorar la calidad de la vida”, afirmándose la necesidad de balancear el desarrollo con la protección del medio humano. Posteriormente, en la Declaración de Río sobre el Medio Ambiente y el Desarrollo (en adelante “Declaración de Río”), los Estados reconocieron que “[l]os seres humanos constituyen el centro de las preocupaciones relacionadas con el desarrollo sostenible” y, a la vez, destacaron que “a fin de alcanzar el desarrollo sostenible, la protección del medio ambiente deberá constituir parte integrante del proceso de desarrollo”.
En seguimiento de lo anterior, en la Declaración de Johannesburgo sobre el Desarrollo Sostenible se establecieron los tres pilares del desarrollo sostenible: el desarrollo económico, el desarrollo social y la protección ambiental. Asimismo, en el correspondiente Plan de Aplicación de las Decisiones de la Cumbre Mundial sobre el Desarrollo Sostenible, los Estados reconocieron la consideración que se debe prestar a la posible relación entre el medio ambiente y los derechos humanos, incluido el derecho al desarrollo. 53. Además, al adoptar la Agenda 2030 para el Desarrollo Sostenible, la Asamblea General de las Naciones Unidas reconoció que el alcance de los derechos humanos de todas las personas depende de la consecución de las tres dimensiones del desarrollo sostenible: la económica, social y ambiental. En el mismo sentido, varios instrumentos del ámbito interamericano se han referido a la protección del medio ambiente y el desarrollo sostenible, tales como la Carta Democrática Interamericana la cual prevé que “[e]l ejercicio de la democracia facilita la preservación y el manejo adecuado del medio ambiente”, por lo cual “es esencial que los Estados del Hemisferio implementen políticas y estrategias de protección del medio ambiente, respetando los diversos tratados y convenciones, para lograr un desarrollo sostenible en beneficio de las futuras generaciones” (…) 55.
Como consecuencia de la estrecha conexión entre la protección del medio ambiente, el desarrollo sostenible y los derechos humanos (supra párrs. 47 a 55), actualmente (i) múltiples sistemas de protección de derechos humanos reconocen el derecho al medio ambiente sano como un derecho en sí mismo, particularmente el sistema interamericano de derechos humanos, a la vez que no hay duda que (ii) otros múltiples derechos humanos son vulnerables a la degradación del medio ambiente, todo lo cual conlleva una serie de obligaciones ambientales de los Estados a efectos del cumplimiento de sus obligaciones de respeto y garantía de estos derechos. Precisamente, otra consecuencia de la interdependencia e indivisibilidad entre los derechos humanos y la protección del medio ambiente es que, en la determinación de estas obligaciones estatales, la Corte puede hacer uso de los principios, derechos y obligaciones del derecho ambiental internacional, los cuales como parte del corpus iuris internacional contribuyen en forma decisiva a fijar el alcance de las obligaciones derivadas de la Convención Americana en esta materia (supra párrs. 43 a 45) (…) 59.
El derecho humano a un medio ambiente sano se ha entendido como un derecho con connotaciones tanto individuales como colectivas. En su dimensión colectiva, el derecho a un medio ambiente sano constituye un interés universal, que se debe tanto a las generaciones presentes y futuras. Ahora bien, el derecho al medio ambiente sano también tiene una dimensión individual, en la medida en que su vulneración puede tener repercusiones directas o indirectas sobre las personas debido a su conexidad con otros derechos, tales como el derecho a la salud, la integridad personal o la vida, entre otros. La degradación del medio ambiente puede causar daños irreparables en los seres humanos, por lo cual un medio ambiente sano es un derecho fundamental para la existencia de la humanidad.”.
Esta interrelación entre el medio ambiente y el disfrute de otros derechos humanos también ha sido reconocida por el Consejo de Derechos Humanos de las Naciones Unidas, quien en la resolución A/HRC/RES/46/7, adoptada el 23 de marzo de 2021 en el 46° periodo de sesiones, sostuvo:
“Reconociendo también que el desarrollo sostenible y la protección del medio ambiente, incluidos los ecosistemas, contribuyen al bienestar humano y al disfrute de los derechos humanos, en particular los derechos a la vida, al disfrute del más alto nivel posible de salud física y mental, a un nivel de vida adecuado, a una alimentación adecuada, al agua potable y el saneamiento y a la vivienda, y los derechos culturales.”.
También, recientemente, en la resolución A/HRC/RES/48/13, adoptada el 8 de octubre de 2021, ese Consejo señaló:
“(…) Reconociendo que el desarrollo sostenible, en sus tres dimensiones (social, económica y ambiental), y la protección del medio ambiente, incluidos los ecosistemas, contribuyen al bienestar humano y al disfrute de los derechos humanos y promueven ambos, incluido el disfrute de los derechos a la vida, al más alto nivel posible de salud física y mental, a un nivel de vida adecuado, a una alimentación adecuada, a la vivienda, al agua potable y el saneamiento y a la participación en la vida cultural, para las generaciones presentes y futuras (…)
Reconociendo además que la degradación del medio ambiente, el cambio climático y el desarrollo insostenible son algunas de las amenazas más acuciantes y graves a la capacidad de las generaciones presentes y futuras de disfrutar de los derechos humanos, incluido el derecho a la vida (…)
Reconociendo la importancia de un medio ambiente limpio, saludable y sostenible como algo fundamental para el disfrute de todos los derechos humanos (…)
1. Reconoce el derecho a un medio ambiente limpio, saludable y sostenible como un derecho humano importante para el disfrute de los derechos humanos; 2. Observa que el derecho a un medio ambiente limpio, saludable y sostenible está relacionado con otros derechos y el derecho internacional vigente (…)”. (El resaltado no corresponde al original).
De este modo, se refleja la particular relevancia del derecho fundamental a un ambiente sano y ecológicamente equilibrado, cuya defensa trasciende la protección de este bien constitucional en sí, toda vez que su preservación constituye un factor esencial para el resguardo efectivo de otros bienes primordiales del ser humano (como la vida, la salud, la propiedad, la igualdad), de modo que si en lo primero se falla, el resguardo efectivo de lo segundo no se alcanza.
Allende de lo anterior, la Corte Interamericana de Derechos Humanos, en la opinión supra aludida, reconoció el derecho a un ambiente sano como uno autónomo, susceptible de protección con independencia de algún riesgo de afectación a personas individuales. En tal sentido, dispuso:
“62. Esta Corte considera importante resaltar que el derecho al medio ambiente sano como derecho autónomo, a diferencia de otros derechos, protege los componentes del medio ambiente, tales como bosques, ríos, mares y otros, como intereses jurídicos en sí mismos, aún en ausencia de certeza o evidencia sobre el riesgo a las personas individuales. Se trata de proteger la naturaleza y el medio ambiente no solamente por su conexidad con una utilidad para el ser humano o por los efectos que su degradación podría causar en otros derechos de las personas, como la salud, la vida o la integridad personal, sino por su importancia para los demás organismos vivos con quienes se comparte el planeta, también merecedores de protección en sí mismos. En este sentido, la Corte advierte una tendencia a reconocer personería jurídica y, por ende, derechos a la naturaleza no solo en sentencias judiciales sino incluso en ordenamientos constitucionales. 63. De esta manera, el derecho a un medio ambiente sano como derecho autónomo es distinto al contenido ambiental que surge de la protección de otros derechos, tales como el derecho a la vida o el derecho a la integridad personal.”. (El resaltado no corresponde al original).
Esta tesitura fue adoptada en la sentencia de 6 de febrero de 2020 relativa al caso “Comunidades Indígenas miembros de la Asociación Lhaka Honhat (Nuestra Tierra) vs. Argentina”, en la que, superando un enfoque antropocéntrico, la CorteIDH afirma que el derecho al ambiente sano, amén de ser fundamental para la propia existencia del ser humano, constituye un derecho autónomo y universal, de manera que la protección a diversos componentes del ambiente (como bosques, mares, ríos y otros) configura un interés jurídico por sí mismo. En palabras de la CorteIDH: “Se trata de proteger la naturaleza”, no solo por su “utilidad” o “efectos” respecto de los seres humanos, “sino por su importancia para los demás organismos vivos con quienes se comparte el planeta.” Dada la trascendencia de esta afirmación, resulta oportuno transcribir este apartado de la referida resolución:
“203. La Corte ya se ha referido al contenido y alcance de este derecho, considerando diversas normas relevantes, en su Opinión Consultiva OC-23/17, por lo que se remite a dicho pronunciamiento. Afirmó en esa oportunidad que el derecho a un medio ambiente sano “constituye un interés universal” y “es un derecho fundamental para la existencia de la humanidad”, y que “como derecho autónomo […] protege los componentes del […] ambiente, tales como bosques, mares, ríos y otros, como intereses jurídicos en sí mismos, aun en ausencia de certeza o evidencia sobre el riesgo a las personas individuales. Se trata de proteger la naturaleza”, no solo por su “utilidad” o “efectos” respecto de los seres humanos, “sino por su importancia para los demás organismos vivos con quienes se comparte el planeta”. Lo anterior no obsta, desde luego, a que otros derechos humanos puedan ser vulnerados como consecuencia de daños ambientales.”. (El resaltado no corresponde al original).
Con base en lo expuesto, esta Sala, como garante de los derechos fundamentales, debe velar por el respeto a las obligaciones convencionales y constitucionales, que constriñen al Estado no solo a reconocer los derechos ahí consagrados, sino también a imponer las medidas jurídicas requeridas para su resguardo” (el resaltado es del original).
Aunado a lo anterior, recientemente, la Asamblea General de las Naciones Unidad adoptó la resolución nro. A/RES/76/1-A/RES/76/300 del 28 de julio de 2022, en la que se consignó:
“1. Reconoce el derecho a un medio ambiente limpio, saludable y sostenible como un derecho humano; 2. Observa que el derecho a un medio ambiente limpio, saludable y sostenible está relacionado con otros derechos y el derecho internacional vigente; 3. Afirma que la promoción del derecho humano a un medio ambiente limpio, saludable y sostenible requiere la plena aplicación de los acuerdos multilaterales relativos al medio ambiente con arreglo a los principios del derecho ambiental internacional; 4. Exhorta a los Estados, las organizaciones internacionales, las empresas y otros interesados pertinentes a que adopten políticas, aumenten la cooperación internacional, refuercen la creación de capacidad y sigan compartiendo buenas prácticas con el fin de intensificar los esfuerzos para garantizar un medio ambiente limpio, saludable y sostenible para todos”.
Esta resolución es la expresión formal de la voluntad del órgano principal de deliberación, adopción de políticas y representación de la Organización de Naciones Unidas. En consecuencia, constituye un compromiso político de carácter universal que debe ser valorado como fuente de soft law de la mayor relevancia.
Precisamente, la resolución nro. A/RES/76/1-A/RES/76/300 afirma que el derecho a un ambiente sano y ecológicamente equilibrado tiene naturaleza de derecho humano. Con esto, en buena medida contribuye a su positivización, de lo que resulta su comprensión técnica como “derecho fundamental”. Asimismo, robustece la noción de que la protección al ambiente es un derecho humano “autónomo”, esto es, que vale por sí mismo, de manera que, por un lado, tiene una existencia conceptual propia y distinta al contenido ambiental que sin duda surge de la protección de otros derechos (como la vida o la salud) y, por otro, su objeto de protección trasciende al ser humano, puesto que brinda cobijo a los diversos componentes de la naturaleza debido a su trascendencia para preservar la existencia de los organismos vivos en general, independientemente de su utilidad para con los seres humanos.
Asimismo, reitera y, por esa vía, fortalece la tesitura de que el derecho a un ambiente sano y ecológicamente equilibrado se encuentra vinculado con otros derechos humanos, lo que implica que su transgresión puede acarrear la vulneración de la salud, la vida, el desarrollo sostenible democrático, por citar tan solo algunos ejemplos. Lo anterior confiere un significado jurídico particularmente relevante al derecho de marras.
En adición, la Asamblea General de la ONU preceptúa que la protección al derecho a un ambiente sano y ecológicamente equilibrado demanda la plena aplicación de los derechos convencionales relacionados con el ambiente en consonancia con los principios del derecho ambiental internacional. De lo anterior se colige su imprescindible inclusión dentro del control jurisdiccional de constitucionalidad por parte de esta Sala.
Por último, en armonía con la reconocida teoría de la eficacia horizontal de los derechos fundamentales (Drittwirkung der Menschenrechte), la resolución nro. A/RES/76/1-A/RES/76/300 regula que la obligación de resguardar al ambiente, allende de los estados, se extiende a organizaciones internacionales, empresas y otros interesados, término último que comprende a los seres humanos en general. Justamente es en ese sentido, que la Ley de la Jurisdicción Constitucional contempla el amparo contra sujetos de derecho privado.
En suma, bajo el marco conceptual explicado ut supra, este Tribunal Constitucional, como garante de los derechos fundamentales, debe velar por el cumplimiento de los compromisos convencionales y constitucionales que al Estado costarricense y a la sociedad en general le imponen no solo la obligación de reconocer los derechos, principios y valores de la materia ambiental, sino también la de implementar todas aquellas medidas y actuaciones que se precisan para asegurar la efectiva protección a aquellos” (el resaltado es del original).
En el sub lite, la parte accionante acusa que su propiedad colinda con un botadero a cielo abierto que tiene la Municipalidad de San Ramón, lo que ocasiona contaminación ambiental y sónica. Expone que el 6 de enero de 2023 planteó una queja ante el gobierno local de San Ramón, mediante el que solicitó el cierre técnico de ese basurero por el mal tratamiento que se le da a la basura y por la contaminación existente, así como con el problema con la naciente, pero no recibió una respuesta positiva. Alega que el 28 de abril de 2023 interpuso una denuncia ante el Área de Salud de San Ramón del Ministerio de Salud; sin embargo, a la fecha no han realizado la inspección que solicitó, ni le brindaron la información peticionada.
La Sala acredita, el 6 de enero de 2023, el amparado planteó una denuncia ante el gobierno local de San Ramón que fue recibida el 20 de enero de 2023 y atendida por oficio MSR-AM-GM-DDU-SMA-016-2023, por medio del cual “se refutaron varios cuestionamientos expuestas (sic) por el señor [Nombre317 001] sobre la gestión de los residuo sólidos que se efectúan en el centro de transferencia municipal”. Además, el 28 de abril de 2023, el accionante formuló la denuncia D-SR131-2023 ante el Ministerio de Salud, por medio de la cual acusó que la Municipalidad de San Ramón tiene en funcionamiento un botadero de basura que afecta, entre otras cosas, una naciente de agua que hay en su propiedad. Además, reportó que: i) los trabajadores que ahí laboran no cuentan con agua potable, por lo que toman de un pozo contaminad; ii) las pilas de tratamiento no existen y los líquidos y ácidos que suelta la basura cae a una quebrada que es rebalse de la naciente que está en su propiedad y que posteriormente discurre hasta el río Barranca; iii) no hay cuneta ni drenajes; iv) no hay chimeneas; y v) la Municipalidad de San Ramón vierte la basura escasos 60 metros de donde está la naciente de agua de la cual se abastece su familia.
En tal escrito se solicitó: i) efectuar una inspección al lugar denunciado; ii) brindar una copia de los permisos emitidos por el Ministerio de Salud en relación con el funcionamiento de ese lugar, así como del expediente administrativo; iii) otorgar una copia de las bitácoras de monitoreo; y iv) cerrar el botadero.
De la prueba se desprende que, el 14 de junio de 2023, el Ministerio de Salud inspeccionó el lugar denunciado. Asimismo, el 15 de junio de 2023, el accionante planteó un escrito ante el Ministerio de Salud en el que externó su descontento con la inspección realizada al sitio denunciado, por lo que requirió efectuar una nueva inspección. Posteriormente, el 22 de junio de 2023, el Ministerio de Salud dictó la orden sanitaria OS-SR-R-160-2023, en la que otorgó un plazo de 20 días hábiles al alcalde de San Ramón para: “1. Presentar ante esta Área Rectora de Salud, para su respectiva revisión y aprobación, un plan remedial que incluya todas las mejoras, modificaciones y obras a realizar para cumplir con el cierre técnico del vertedero de basura que funcionó en propiedad ubicada en Dirección2220 . Este deberá incluir de manera prioritaria el suministro de agua potable a los trabajadores. 2. Solicitar el permiso sanitario de funcionamiento del centro de transferencia de residuos administrado por la Municipalidad de San Ramón. 3.
Cumplir con la presentación ante este Ministerio de Salud del avance de las obras de cierre y los análisis de laboratorio, practicados trimestralmente de las obras de cierre del vertedero y semestralmente de los pozos de monitoreo. 4. La Estación de transferencia deberá contar con: a. Sistemas que garanticen los límites máximos permitidos que les sean aplicables en materia de emisiones a la atmósfera, vertido de aguas residuales, ruido y vibraciones; de acuerdo con la reglamentación vigente. b. Un botiquín de primeros auxilios rotulado y ubicado en un lugar limpio y seco, protegido de los cambios ambientales que afectan a los medicamentos. Se deberá verificar el estado y fecha de caducidad de estos. c. Extintores, en cantidad y tipo de acuerdo con la carga de fuego; ubicados estratégicamente dentro del establecimiento. d. Programas permanentes para el control de fauna nociva que cuenten como mínimo los productos utilizados en la fumigación y la fecha de estas. e. La zona de descarga contará con techumbre que cubra la tolva o ranura y el vehículo recolector en la zona de descarga.
La altura de la techumbre será como mínimo 6 metros y cada carril de descarga deberá tener una anchura mínima de 3 metros. f. La tolva o ranura debe contar con un tope para impedir que los vehículos recolectores puedan caer en ella al aproximarse para la descarga. g. Los servicios sanitarios deben contar con pisos y paredes de material liso e impermeable que faciliten su limpieza, estar equipados con papel higiénico, jabón de manos, toallas de papel o sistema mecanizado de secado de manos”. Tal memorial fue notificado al alcalde de San Ramón el 23 de junio de 2023.
Adicionalmente, el 29 de junio de 2023, el recurrente planteó una gestión ante el ministerio accionado en la que expuso que los días que van del 27 al 29 de junio de 2023 había basura sin recoger y malos olores, entre otras cosas. Por oficio MS-DRRSCO-DARS-SR-0942-2023 del 3 de julio de 2023, el Ministerio de Salud le comunicó al recurrente: “En atención de la denuncia D-SR-131-2023, interpuesta por usted ante esta Área Rectora de Salud, se designa a la Licda. Rosa María Chaves Jiménez la responsabilidad de brindar cobertura a la denuncia, en la que se plantea el problema relacionado son el funcionamiento de un “botadero de basura”, propiedad de la Municipalidad de San Ramón, se indica que se procedió a realizar visita de inspección d día 13 de junio de 2023. emitiéndose el informe técnico MSDARSSR-RS-0589-2023 y la orden sanitaria OS-SR-R-160-2023. en el cual se Indica: (…) Posterior se informará el resultado según lo ordenado en la orden sanitaria OS-SR-127-2023. Con respecto a los escritos presentados el 15 y 29 de junio de 2023 se le indica que se programa una nueva visita para el miércoles 05 de julio de 2023”.
El 5 de julio de 2023, el Ministerio de Salud inspeccionó el lugar denunciado en compañía del recurrente. Por memorial MS-DARSSR-RS-706-2023 del 18 de julio de 2023, el Área Rectora de Salud de San Ramón expuso: “Previo a referirse a los resultados de la evaluación, es importante mencionar que todos los puntos relacionados con las irregularidades de operación del centro de transferencia, y de las obras de cierre técnico del antiguo vertedero controlado, fueron contemplados en oficio MS-DARSSR-RS-0589-2023 de fecha 15 de junio del 2023 y orden sanitaria OS-SR-R-160-2023.Para intervención de la denuncia SR-131-2023, se coordinó previamente con el señor [Nombre317 001] y se realizó una primera evaluación en fecha 13 de junio del presente año, con el objetivo de identificar las molestias desde el punto de vista de salud que le afectaban dentro de su propiedad, razón por la cual no es cierto que el asunto no fuese coordinado previamente con él y se conoció la naciente siendo acompañados por su persona y su hijo Nombre10386 .
En la visita realizada el día 5 de julio del 2023 nos acompañaron los señores Carlos Abarca Mora, cédula CED5145, trabajador municipal, José Luis Jiménez Castrillo quien se identifica como abogado del denunciante, [Nombre317 001], denunciante y Nombre10386 , hijo del denunciante. Se valoran todos los puntos que fueron mencionados en denuncia SR-131-2023, obteniendo los mismos resultados descritos en oficio MS-DARSSR-RS-0589-2023, de fecha 15 de junio del 2023. (…) Adicionalmente se valoraron las pilas para el manejo de lixiviados, las áreas donde se está realizando obras de cierre técnico, las áreas de casetilla de guarda, área de oficinas, área de comedor, los cuales de la misma manera fueron evaluados el 14 de junio del presente año. Se les informa a los acompañantes en la visita que todas las deficiencias identificadas fueron planteadas en orden sanitaria N° OS-SR-R-160-2023 la cual fue notificada al Sr. Nixon Ureña Guillen en fecha 23 de junio del presente año.
A solicitud de esta Área Rectora de Salud, la Municipalidad de San Ramón aportó pruebas de acciones inmediatas realizadas para eliminar la filtración de lixiviados al sistema de alcantarillado pluvial del proyecto. Igualmente presentó documento denominado PLAN REMEDIAL PARA EL CIERRE TÉCNICO DEL VERTEDERO MUNICIPAL Y LA OPERACIÓN DE LA ESTACIÓN DE TRANSFERENCIA DE RESIDUOS SÓLIDOS ORDINARIOS, el cual esté en proceso de evaluación por parte de esta Área Rectora de Salud (se adjunta documento). Se presentó igualmente solicitud de permiso de funcionamiento para el Centro de transferencia, el cual está en trámite para su aprobación o rechazo” (el resaltado fue incorporado).
Ahora bien, en cuanto a la denuncia formulada el 6 de enero de 2023 ante la Municipalidad de San Ramón, la Sala observa que, aun cuando por memorial MSR-AM-GM-DDU-SMA-016-2023 “se refutaron varios cuestionamientos expuestas (sic) por el señor [Nombre317 001] sobre la gestión de los residuo sólidos que se efectúan en el centro de transferencia municipal”, no menos cierto es que en el fondo no se atendió lo acusado por el recurrente. Lo anterior se evidencia con el hecho de que, ante una inspección efectuada en junio de 2023 por el Ministerio de Salud en el lugar denunciado, se corroboraron varias faltas que derivaron en la emisión de la orden sanitaria OS-SR-R-160-2023, en la que se constriñe al alcalde de San Ramón a “1. Presentar ante esta Área Rectora de Salud, para su respectiva revisión y aprobación, un plan remedial que incluya todas las mejoras, modificaciones y obras a realizar para cumplir con el cierre técnico del vertedero de basura que funcionó en propiedad ubicada en Dirección2220 .
Este deberá incluir de manera prioritaria el suministro de agua potable a los trabajadores. 2. Solicitar el permiso sanitario de funcionamiento del centro de transferencia de residuos administrado por la Municipalidad de San Ramón. 3. Cumplir con la presentación ante este Ministerio de Salud del avance de las obras de cierre y los análisis de laboratorio, practicados trimestralmente de las obras de cierre del vertedero y semestralmente de los pozos de monitoreo. 4. La Estación de transferencia deberá contar con: a. Sistemas que garanticen los límites máximos permitidos que les sean aplicables en materia de emisiones a la atmósfera, vertido de aguas residuales, ruido y vibraciones; de acuerdo con la reglamentación vigente. b. Un botiquín de primeros auxilios rotulado y ubicado en un lugar limpio y seco, protegido de los cambios ambientales que afectan a los medicamentos. Se deberá verificar el estado y fecha de caducidad de estos. c. Extintores, en cantidad y tipo de acuerdo con la carga de fuego; ubicados estratégicamente dentro del establecimiento. d. Programas permanentes para el control de fauna nociva que cuenten como mínimo los productos utilizados en la fumigación y la fecha de estas. e. La zona de descarga contará con techumbre que cubra la tolva o ranura y el vehículo recolector en la zona de descarga.
La altura de la techumbre será como mínimo 6 metros y cada carril de descarga deberá tener una anchura mínima de 3 metros. f. La tolva o ranura debe contar con un tope para impedir que los vehículos recolectores puedan caer en ella al aproximarse para la descarga. g. Los servicios sanitarios deben contar con pisos y paredes de material liso e impermeable que faciliten su limpieza, estar equipados con papel higiénico, jabón de manos, toallas de papel o sistema mecanizado de secado de manos”.
Por ende, se declara con lugar el recurso en cuanto a la corporación municipal de San Ramón, según lo establecido en la parte dispositiva de este pronunciamiento.
VI.De otro lado, en el caso bajo estudio se tiene por demostrado que, el 28 de abril de 2023, el accionante formuló una denuncia ante el Ministerio de Salud. Sobre el particular, este Tribunal verifica que al momento en el que el recurrente acudió ante esta jurisdicción especializada, a saber, el 2 de junio de 2023, apenas había transcurrido poco más de un mes desde la formulación de la denuncia en cuestión, motivo por el cual el recurso deviene prematuro respecto a este agravio. Por ende, no se estima el amparo en lo que a este extremo concierne.
En todo caso, en la especie ha quedado plenamente demostrado que, ante la denuncia en cuestión, el Ministerio de Salud ha adoptado diversas medidas, entre las que destacan dos inspecciones efectuadas al lugar denunciado, así como la emisión de una orden sanitaria. Aclarado lo anterior, advierta el accionante que no compete a este Tribunal Constitucional pronunciarse, de acuerdo con la normativa infraconstitucional que rige la materia y las particularidades del caso bajo estudio, sobre las inconformidades manifestadas respecto a las inspecciones referidas, a la orden sanitaria dictada por ese ministerio, ni al plan remedial requerido a la corporación municipal recurrida. Tampoco corresponde a esta Sala especializada referirse sobre lo expuesto en relación con la ubicación de la naciente que el recurrente aduce que existe en su propiedad. Ello por cuanto, tales extremos son de legalidad y, por ende, corresponden ser dilucidados ante la propia autoridad recurrida o en la vía jurisdiccional ordinaria.
VII.A pesar de lo anterior, en el sub examine se verifica la lesión a los derechos fundamentales del amparado por parte del Ministerio de Salud, debido a la omisión en atender las peticiones contenidas en la denuncia del 28 de abril de 2023. Cabe recordar que, en esa gestión, el accionante requirió: i) efectuar una inspección al lugar denunciado; ii) brindar una copia de los permisos emitidos por el Ministerio de Salud en relación con el funcionamiento de ese lugar, así como del expediente administrativo; iii) otorgar una copia de las bitácoras de monitoreo; y iv) cerrar el botadero.
Sobre el particular, nótese que lo solicitado en los puntos i) y iv) refiere a las pretensiones propias de la denuncia interpuesta, respecto de lo cual se hizo referencia en el considerando previo de este pronunciamiento y, por ende, lo acusado resulta prematuro. Empero, lo requerido en los puntos ii) y iii) constituyen solicitudes de información, motivo por el cual no se está ante algún tipo de reclamo administrativo, sino frente una eventual violación al artículo 30 constitucional. Respecto de este tipo de agravio, la Sala no observa que el amparo sea prematuro, por lo que procede verificar si se ha producido o no una lesión a los derechos fundamentales de la parte amparada en los términos acusados.
Al respecto, en el sub iudice se tiene como incontrovertido que el Ministerio de Salud no atendió lo solicitado por el recurrente en los puntos ii) y iii) de la gestión del 28 de abril de 2023, toda vez que no se constata que se haya dado respuesta alguna al respecto. Por lo tanto, se estima el amparo en cuanto a estos puntos concierne, ante la lesión al derecho a la información.
He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.
Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.
Por tanto:
En cuanto a la Municipalidad de San Ramón, se declara con lugar el recurso. Se les ordena a Nixon Ureña Guillén, Hermelink Chinchilla Corrales y Allan Artavia Jiménez, por su orden, alcalde, presidente del Concejo y funcionario destacado en los Servicios Municipales Ambientales, ambos de la Municipalidad de San Ramón, o a quienes en su lugar ocupen esos cargos, que coordinen lo necesario y lleven a cabo todas las actuaciones dentro del ámbito de sus respectivas competencias, a los efectos de cumplir lo dispuesto en la orden sanitaria OS-SR-R-160-2023 dictada por el Ministerio de Salud el 22 de junio de 2023. En cuanto al Ministerio de Salud, se declara con lugar el recurso solo en cuanto a la falta de respuesta a los puntos ii) y iii) de la gestión formulada por el accionante el 28 de abril de 2023. Se le ordena a Ana Isabel Rodríguez Sánchez, en su condición de directora del Área Rectora de Salud de San Ramón, o a quien en su lugar ocupe ese cargo, coordinar lo necesario y llevar a cabo todas las acciones que estén dentro del ámbito de sus competencias, a fin de que, en el plazo máximo de CINCO DÍAS, contado a partir de la notificación de esta sentencia, se atienda como en derecho corresponda lo peticionado por el recurrente en los puntos ii) y iii) de la gestión del 28 de abril de 2023, a saber, ii) brindar una copia de los permisos emitidos por el Ministerio de Salud en relación con el funcionamiento de ese lugar, así como del expediente administrativo; y iii) otorgar una copia de las bitácoras de monitoreo, y se le notifique lo correspondiente.
Lo anterior se dicta con el apercibimiento de que con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quienes recibieren una orden que deban cumplir o hacer cumplir, dictada en un recurso de amparo y que no la cumplieren o no la hicieren cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San Ramón y al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Castillo Víquez pone nota. En lo demás se declara sin lugar el recurso. Notifíquese.
