Document PJEDITOR Decision No. PHO5487 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty on veintiuno de julio de dos mil veintitres.
Constitutional protection action (recurso de amparo) being processed under case file no. 23-015195-0007-CO, filed by [Nombre317 001], identity card [Valor CED165], against the UNIVERSIDAD DE COSTA RICA (UCR).
Findings:
It is important to clarify that bamboo may provide shelter or perches for birds, but it does not serve as food for the fauna in the area, and it cannot be declared a bamboo forest because it is an exotic herbaceous plant species. Furthermore, it is important to understand the ecology of the species Bambusa vulgaris before drawing connections to food chains involving birds and insects, since it is not recorded as a food source and its culms are even toxic to humans and other mammals. Fact 8: Damage to air quality Although bamboo has a high capacity to absorb carbon dioxide, the affected clump covers an approximate area of 500 m*, and therefore the scientific correlation regarding the impact on air quality cannot be conclusive. Furthermore, burning plastics generates other compounds, such as carbon monoxide, heavy metals, dioxins, and furans. Heavy metals may be taken up by plant species through their roots; however, they behave as airborne particles and will not be absorbed by plant species.
The way to prevent dioxins and furans from entering the air is to control their emission sources; that is, through controls designed to prevent the burning of plastic Cables, which are the identified sources of generation in this case. Under current pollution conditions, all persons have a history of exposure to low levels, which are estimated not to affect human health. Fact 9: Damage to the acoustic environment In this case, there is no evidence that the bamboo clump attenuated noise, since there are no measurements supporting that assertion from before and after the pruning. Noise has two components: one is physical and can be quantified using measuring instruments (sound-level meters), while the other is its perception, which is entirely subjective. Executive Decree 39428-S Reglamento para el Control de la Contaminación por Ruido establishes the maximum permissible limits for noise-emitting sources.
Nevertheless, the alleged noise is not generated by the Universidad and is attributable to the ambient noise of an urban area adjoining a municipal street with heavy vehicular traffic. Fact 10: Personal injuries Based on an observation by the Forestry Engineer (Ingeniero Forestal) of the Unidad de Gestión Ambiental, it was verified that no indiscriminate deforestation occurred in connection with this case, and that the work performed consisted of a specific maintenance activity on the bamboo clump to prevent damage to the property of the neighbor, Ms. Nombre9312 , and to address the risk that the clump could collapse due to its height, which posed a threat to her personal safety. Regarding the appellant’s health condition, a review of medical referral N* 20230001551766, submitted with the initial filing, dated June 23, 2023, at 2:39 pm, disclosed the appellant’s chronic ailments and state of health.
However, his condition cannot be associated with the work performed on June 24 and 25, and July 1 and 2, 2023, as the activities performed are described in the attached official letter OSG-1001-2028. In no way does the Universidad act with the intention of harming the health of its neighbors, users, or the general population; rather, it works to maintain cordial relations with its neighbors through the administration and preventive maintenance of its properties. This is evidenced by other assistance provided to neighbors of Dirección814 , sports facilities, as in the case of Mr. Nombre9313 , who processed Externo-VRA-762-2021, attached hereto. This is in addition to the socio-environmental contributions made as an institution of higher education, as a member of the Comité Local del Corredor Biológico interurbano del Río Torres, and through its work to conserve the canton’s biodiversity and enhance the ecosystem services (servicios ecosistémicos) of the 4 properties of Sede Rodrigo Facio, by planting 250 trees between 2022 and the portion of 2023 elapsed to date, grown at the institutional nursery located at Finca Experimental de Santa Ana.”
Justice Rueda Leal delivers the opinion; and,
Whereas:
I.Subject matter of the writ. The petitioner alleges that UCR deforested part of the riverbank of the río Torres, causing damage to the landscape and soil, water infiltration into aquifers, the river’s biological corridor, flora and fauna, air quality, and acoustic quality, as well as health problems and psychological harm.
II.Proven facts. The following facts relevant to the decision in this matter are deemed duly established, either because they have been substantiated or because the respondent failed to address them, as ordered in the initial ruling:
III.The specific case. In the case at bar, the petitioner alleges that UCR deforested part of the riverbank of the río Torres, causing damage to the landscape and soil, water infiltration into aquifers, the river’s biological corridor, flora and fauna, air quality, and acoustic quality, as well as health problems and psychological harm. After reviewing the record, the Chamber found it established that, on 24 and 25 de junio de 2023, UCR pruned the bamboo clump located on the riverbank of the río Torres, on its property known as Dirección1755, covering an area of approximately 500 m2. It was established that the pruning was requested by a neighbor because the bamboo had grown to more than 25 meters in height, extended toward the neighbor’s home, and endangered her safety and property. With respect to the petitioner’s claims, the Chamber verified that the intervention did not result in the loss of forest cover or the removal of the bamboo clump.
Moreover, the type of bamboo (bambusa vulgaris) that was pruned is not an indigenous or native species of Costa Rica. It is a toxic herbaceous plant and is therefore not recognized as a food source for birds and insects. In fact, on 4 de julio de 2023, Dirección1755 was inspected by two environmental managers. No disturbance or death of animals, plants, or trees was observed in the affected area. The foregoing shows that UCR’s activity consisted of pruning the bamboo in order to safeguard a neighbor’s rights, given that the bamboo, because of its size, endangered her safety and her property. In other words, it was not an arbitrary or unjustified activity, but one intended to protect the fundamental rights of a third party. Finally, the Chamber recalls that amparo proceedings (proceso de amparo) are summary in nature and, as such, are unsuitable for extensive and complex evidentiary proceedings.
Should the petitioner’s disagreement persist, he may pursue his rights through ordinary legal channels if he so chooses. In view of the statement made by the respondent authorities, it is clarified that an award of costs against the petitioner is warranted only in cases of recklessness (artículo 51 de la Ley de la Jurisdicción Constitucional), which is not present in the case at bar. In light of the foregoing, the writ is denied.
IV.Note by Justice Salazar Alvarado. In environmental matters, it is the undersigned’s view that, where the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative litigation courts. Nevertheless, I do address the merits when other rights of persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (artículo 50, de la Constitución Política), as occurs in this case, in which the petitioner states that he lives across from the Universidad de Costa Rica property where the sports and recreational facilities in Sabanilla de Montes de Oca are located. He states that the boundary between Sabanilla and Guadalupe de Goicoechea is the Río Torres. However, the petitioner alleges that the Universidad de Costa Rica deforested part of the riverbank of the río Torres, causing damage to the landscape and soil, water infiltration into aquifers, the river’s biological corridor, flora and fauna, air quality, and acoustic quality, as well as health problems and psychological harm. The foregoing adversely affects his right to a healthy and ecologically balanced environment.
V.Documentation submitted to the case file. The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any electronic, computer, magnetic, optical, or telematic device or produced using new technologies, these must be retrieved from the court office within no more than 30 business days from notification of this judgment. The parties are warned that any material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, published in the Boletín Judicial nro. 19 del 26 de enero de 2012, as well as the agreement of the Consejo Superior del Poder Judicial, approved in artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.

Documento PJEDITOR Res. Nº PHO5487 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del veintiuno de julio de dos mil veintitres .
Recurso de amparo que se tramita en el expediente nro. 23-015195-0007-CO, interpuesto por [Nombre317 001], cédula de identidad [Valor CED165], contra la UNIVERSIDAD DE COSTA RICA (UCR).
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Objeto del recurso. El recurrente alega que la UCR deforestó parte de la ribera del río Torres, ocasionando daños paisajísticos, al suelo, a la infiltración de aguas hacia los acuíferos, al corredor biológico del río, a la flora y fauna, a la calidad del aire y a la calidad acústica, así como problemas de salud y daños psicológicos.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:
III.Sobre el caso concreto. En el sub examine, el recurrente alega que la UCR deforestó parte de la ribera del río Torres, ocasionando daños paisajísticos, al suelo, a la infiltración de aguas hacia los acuíferos, al corredor biológico del río, a la flora y fauna, a la calidad del aire y a la calidad acústica, así como problemas de salud y daños psicológicos. Analizados los autos, la Sala tuvo por probado que, los días 24 y 25 de junio de 2023, la UCR podó la cepa de bambú que se encuentra en la ribera del río Torres, en la denominada Dirección1755 de su propiedad, en un área de 500 m2, aproximadamente. Se constató que la poda fue requerida por una vecina, toda vez que el bambú alcanzaba más de 25 metros de altura, cruzaba hacia la vivienda de la vecina y ponía en riesgo su seguridad y propiedad. Con respecto a los reclamos del accionante, la Sala verificó que la intervención no significó pérdida de cobertura boscosa, ni la eliminación de la cepa de bambú.
Incluso, el tipo bambú (bambusa vulgaris), objeto de poda, no es una especie autóctona o nativa de Costa Rica. Es una planta herbácea que presenta toxicidad, por lo que no se registra como fuente de alimento para aves e insectos. De hecho, el 4 de julio de 2023, Dirección1755 fue inspeccionada por dos gestores ambientales. No se observó alteración o muerte de animales, plantas o árboles en la zona intervenida. Ahora bien, se extrae de lo expuesto que la actividad de la UCR consistió en una poda del bambú, con el propósito de velar por los derechos de una vecina, visto que el bambú, por su tamaño, ponía en riesgo su seguridad y la de su propiedad. Es decir, no se trató de una actividad arbitraria o injustificada, sino tendente a la protección de derechos fundamentales de un tercero. Finalmente, la Sala recuerda que el proceso de amparo es sumario y, como tal, inidóneo para actividades probatorias extensas y complejas.
En caso de que persista la inconformidad del recurrente, podrá acudir a la vía de la legalidad a hacer valer sus derechos, si a bien lo tiene. Vista la manifestación de las autoridades accionadas, se aclara que la condenatoria en costas a la parte actora solo procede en caso de temeridad (artículo 51 de la Ley de la Jurisdicción Constitucional), lo que no se observa en el sub lite. En virtud de lo expuesto, se declara sin lugar el recurso.
IV.Nota del Magistrado Salazar Alvarado. En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que el recurrente refiere que vive frente de la finca de la Universidad de Costa Rica, donde se ubican las instalaciones deportivas y recreativas en Sabanilla de Montes de Oca. Refiere que el límite entre Sabanilla y Guadalupe de Goicoechea es el Río Torres. Sin embargo, acusa la parte recurrente que la Universidad de Costa Rica deforestó parte de la ribera del río Torres, ocasionando daños paisajísticos, al suelo, a la infiltración de aguas hacia los acuíferos, al corredor biológico del río, a la flora y fauna, a la calidad del aire y a la calidad acústica, así como problemas de salud y daños psicológicos. Lo anterior, con afectación a su derecho a un ambiente sano y ecológicamente equilibrado.
V.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidos en algún dispositivo de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en el plazo máximo de 30 días hábiles contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo aquel material no retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 del 22 de agosto de 2011, publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012, así como en el acuerdo de Consejo Superior del Poder Judicial, aprobado en el artículo LXXXI de la sesión nro. 43-12 celebrada el 3 de mayo de 2012.
Por tanto:
Se declara sin lugar el recurso. El Magistrado Salazar Alvarado pone nota.
