Document Review Decision No. 2023001890 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine fifteen in the morning on the twenty-seventh of January, two thousand twenty-three.
Amparo proceeding (recurso de amparo) processed under case file No. 22-028814-0007-CO, filed by Nombre78921, identity card CED45590, against the MUNICIPALIDAD DE SAN JOSÉ and the COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS (CNE).
Findings of Fact:
Within its ordinary powers, pursuant to Ley N° 8488, it has the following obligation: Article 14°—The Commission’s ordinary prevention powers. The Commission shall be the governing entity with respect to risk prevention and preparedness for responding to emergency situations. It shall fulfill the following duties: (…) c) Issue binding resolutions concerning situations of risk, disaster, and imminent danger, based on technical and scientific criteria, aimed at guiding regulatory and oversight actions for their effective prevention and management, and regulating or requiring effective compliance therewith by State institutions, the private sector, and the general population. Under no circumstances may officials of the bodies and entities responsible for executing or implementing such binding resolutions decline to apply them. Natural or legal persons, whether public or private, who improperly build in or use areas restricted by such binding resolutions shall be required to demolish or remove the structure, pursuant to Article 36 of this Law. (…).
It should be noted that, as part of its extraordinary powers, Ley N° 8488 authorizes CNE to respond to local and minor emergencies through the “First Impacts” mechanism, since the final paragraph of Article 15 provides: “(…) Except as provided in the preceding subsections, the Commission shall respond, without an emergency declaration by the Executive Branch, to local and minor emergencies which, because of the high frequency with which they occur and the serious harm they cause to communities, require the provision of first-impact humanitarian assistance, consisting of the delivery of blankets, food, and sleeping mats and, if necessary, the procurement of materials to restore basic services and establish shelters, as well as the hiring of a maximum of one hundred machine-hours to clean the most severely affected area of the zone. (Emphasis added).” The final paragraph of Article 15 refers to first-impact humanitarian assistance.
The Law uses the term “first impact” to refer to the first phase of response to a declared emergency. Indeed, Article 30 of the Law, which divides such response into the response, rehabilitation, and, finally, reconstruction phases, establishes that the response phase immediately follows the occurrence of the event. This phase includes urgent first-impact measures intended to safeguard life, vital public-service infrastructure, property, and the environment. It also includes mitigation works (obras de mitigación) aimed at protecting the population, infrastructure, and the environment. Article 4 defines response as actions taken immediately after an emergency occurs; they seek to bring a situation under control in order to safeguard structures and lives, prevent greater damage, and stabilize the area of the region directly affected by the emergency. Accordingly, without an emergency declaration, the Commission may respond to local and minor emergencies, for which purpose the hiring of a maximum of 100 machine-hours to clean the affected area is permitted.
Likewise, Article 30(a) of the same law establishes that the response phase, which is an operational phase occurring immediately after the event, includes urgent first-impact measures intended to safeguard life, vital public-service infrastructure, and the production of goods and services through alert, alarm, evacuation, and relocation actions, among others.
With regard to the specific case, in 2017 a severe rainy season caused landslides adjacent to the appellant’s property. As a result, the affected party appeared before the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias to seek assistance and intervention concerning the landslide. The institution I represent acted diligently and, in response to the request of Ms. Lorena Romero Vargas, head of the Oficina de Prevención y Atención de Desastres of the Municipalidad, conducted a visual risk assessment (evaluación visual de riesgo) in the La Florida Norte development. This resulted in Informe N° IAR-INF-1008-2017, dated 20 de noviembre de 2017, signed by Juan Ignacio Chaves Salas, Geologist with the Unidad de Investigación y Analisis (sic) del Riesgo, and Lidier Esquivel Valverde, head of that Unit. The recommendations section of that report stated as follows: “(…) VI: Recommendations A. Residents whose properties adjoin the hazardous slope (talud) must be notified so that they remain vigilant for further detachments and alert during extraordinary weather events, allowing them to take preventive measures in a timely manner; particularly Ms.
Nombre78921, whose risk is greater because of the property’s proximity to the slope. B. Drainage systems must be installed on the slope to ensure proper stormwater management, prevent soil saturation, and reduce the risk of further detachments. C. Consideration must be given to the possibility of undertaking protective works or dredging to place rocks along the riverbank and reduce the effects of lateral erosion. D. To undertake works within a publicly owned watercourse (cauce de dominio público), the respective permits must be obtained from the Departamento de Aguas of MINAET and the corresponding Municipalidad; these institutions must therefore be reminded of their responsibility to facilitate any necessary application. A. The actions undertaken must be supported by the corresponding technical studies and supervised by a competent, accredited professional. (…)”. It has also been established that, when the appellant approached this institution for the second time, in mayo de 2022, her request was handled diligently and another visual and qualitative risk assessment was conducted on land located at Dirección5366, on the left bank of the río Torres. The purpose of this assessment was to evaluate the stability of the slopes along the banks of the watercourse near that land in order to analyze the risk and vulnerability associated with lateral erosion and scouring (socavamiento) caused by flooding and extraordinary rainfall. That assessment resulted in Informe N° CNE-UIAR-INF-0521-2022, dated 30 de mayo de 2022, signed by Blas Enrique Sánchez Ureña, Geologist with the Unidad de Investigación y Analisis (sic) del Riesgo, and Lidier Esquivel Valverde, head of that Unit. The recommendations section of that report stated as follows: “(…) VI. Recommendations A. An adequate system for controlling, collecting, and draining stormwater and surface runoff is recommended for the property owned by Ms.
Nombre78921 and the adjoining property where the Municipal park is located, so that such water is not discharged toward the slope with stability problems or the bank of the watercourse, thereby causing erosion and continual detachments. B. The required setback from the río Torres watercourse must be observed. This setback is defined as the protected area (zona de protección) established under Article N° 33 of Ley Forestal 7575, where buildings and infrastructure are not permitted. C. It is recommended that the Municipalidad de San José NOT issue building permits in the protected areas of rivers, streams, and drainage ditches that drain the canton, or in filled areas, areas with steep slopes, or areas vulnerable to natural hazards. D. Ms. Nombre78921, the Municipalidad de San José, and all residents whose properties adjoin the río Torres watercourse in the section assessed must arrange for a forestry engineer to evaluate the trees located along the edge of the watercourse, in order to determine whether they can be pruned or removed as soon as possible to reduce weight due to their location in the area, since they increase soil instability at the site, after applying for authorization to cut them and coordinating with the Dirección de Aguas of MINAE.
E. The Municipalidad de San José must provide Ms. Nombre78921 with durable plastic sheeting to be placed on the slope of the río Torres, which exhibits cracking and the potential for further collapses, in order to prevent continual stormwater infiltration from triggering additional material falls. F. After reducing the weight on the slope by removing vegetation that increases instability, Ms. Nombre78921, in coordination with the Municipalidad de San José and all residents whose properties adjoin the río Torres watercourse, must plant low-growing, lightweight vegetation with a highly developed root system (such as vetiver), which helps preserve the soil and maintain slope stability, thereby reducing erosion and material detachments. G. The Municipalidad de San Joseé must remove the debris and materials found in the río Torres watercourse and properly channel the watercourse to help reduce lateral erosion in the assessed area and improve its hydraulic capacity.
H. The Municipalidad de San José, in coordination with the affected residents at the assessed site, must apply to the Dirección de Aguas of MINAET for authorization to undertake slope-stabilization works (obras de estabilización del talud) within the watercourse and protected area of the rio Torres, so as to provide support and stability to the slopes that are currently unstable and prone to landslides. I. Any construction or stabilization works implemented in the assessed area must be supervised by a professional who is a member of the Colegio Federado de Ingenieros y Arquitectos de Costa Rica, in accordance with the standards established by the Código Sísmico, Código de Cimentaciones y Reglamento de Construcciones, Código Municipal, and other legislation in force. J. Any irregularity in construction techniques or failure to follow the recommendations described herein SHALL BE THE SOLE RESPONSIBILITY of the institutions issuing the permits, the engineer or person responsible for the works, and the respective Municipalidad if it fails to request the corresponding reports, inspections, and corrections.
It should be stated that the foregoing establishes that the institution I represent has acted diligently and processed the requests related to the matter at issue, and that the Municipalidad de San José is responsible for complying with the recommendations provided in Informe N° IAR-INF-1008-2017, dated 20 de noviembre de 2017, and Informe N° CNE-UIAR-INF-0521-2022, dated 30 de mayo de 2022. The municipal entity was informed of the foregoing in the section entitled Scope of the Report, item B of which states as follows: “(…) B. In accordance with the decisions issued by the Sala Constitucional concerning the technical criteria provided by specialized CNE officials and the Comités Asesores Técnicos, it is clarified that the recommendations in this report are binding upon the institutions to which they are directed (agreement 443-2011 of the Junta Directiva de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias). Furthermore, that agreement establishes a series of steps consistent with the country’s current regulations concerning the regulatory actions and measures that municipalities must implement in the field of Risk Management (Gestión del Riesgo). (…)”.
Additionally, the CNE Reconstruction Process Management Unit was consulted as to whether, during the period between the years 2017 and 2022, work had been carried out under the Primeros Impactos modality at the request of the Municipalidad de San José. Mr. Orlando Marín Fallas, head of that Unit, responded by email as follows: “(…) Regarding the inquiry as to whether, during the period ‘2017 y 2022, work under Primeros Impactos was carried out in the area of Provincia San José, Cantón San José, Dirección522, Dirección50, Dirección5367, on the left bank of the río Torres (coordinates North 527.2500E / 214.300N),’ please be advised that no Primeros Impactos interventions have been carried out in the río Torres (…)”. Accordingly, this Commission has addressed the requests of either the petitioner or the Municipalidad de San José efficiently and promptly, providing them with recommendations with which they must comply in order to prevent major disasters.
As can be seen from the foregoing, the CNE has acted proactively within our legal framework by responding to the requests submitted by the Municipalidad de San José; compelling municipalities to comply with those recommendations falls outside our scope of authority. Lastly, it should be noted that watercourse maintenance work, as a preventive measure (medida preventiva), must be performed either by the local government or by the Dirección de Obras Fluviales del Ministerio de Obras Públicas y Transportes, since this work, as an ordinary action, cannot and must not be undertaken by the CNE; otherwise, this would amount to replacing action through ordinary channels with an exceptional regime, which is clearly improper under the provision cited throughout this report. (…) X. RELIEF SOUGHT (PRETENSIÓN) Por tanto, I request that this report be deemed duly submitted, that this writ of amparo (Recurso de Amparo) be dismissed insofar as this Commission is concerned, and, with all due respect, that the Honorable Justices order the case closed and release the entity I represent from constitutional liability, pursuant to Article 9 of the Ley de la Jurisdicción Constitucional”.
Justice Cruz Castro drafts the opinion; and,
Whereas:
I.Regarding the exception under Article 41 of the Political Constitution. Before examining the merits of the matter, it must be clarified that, since judgment n.° 2008002545 of 8:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which it is disputed whether the Public Administration has complied with the time limits established by the General Law of Public Administration (articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding—initiated ex officio or at the request of a party—by means of a final administrative act or to hear the applicable administrative appeals. Specifically, the sub lite presents one such exception, because it concerns a complaint regarding a slope (talud) that could potentially endanger the life and physical integrity of the appellant, which allegedly has not been resolved within a reasonable period. Having clarified this point, the Chamber proceeds to rule on the specific situation challenged in this amparo proceeding.
II.Subject matter of the appeal. The petitioner states that, in 2017, following a severe rainy season, several landslides began near the municipal park adjacent to her property. She asserts that one of those landslides was approximately 50 metros from her property. Because of that situation, she appeared before the Comisión Nacional de Emergencias and the Municipalidad de San José, requesting that they intervene with respect to the landslide because, if it continued, it would affect her property. She states that the Municipalidad told her that the area needed to be reforested, which was done; however, in 2022, because of the heavy rains, another landslide occurred, this time causing more land to give way and creating an enormous hole that is now barely 1 metro from reaching the rear of her house. Consequently, she again approached the Comisión Nacional de Emergencias and the Municipalidad de San José.
She asserts that the Municipalidad provided her with a plastic sheet that does not cover even one-fourth of the landslide. The Comisión Nacional de Emergencias also recommended the following: “a) stabilize the slope as part of the responsibilities of the Municipalidad de San José; b) cut down the trees and plant ‘vertivery C’ grass; c) construct drainage channels so that the water drains toward the front of the park and not toward the slope.” She adds that she received no response from the Municipalidad and therefore had to approach the Defensoría de los Habitantes; following its intervention, the Municipalidad stated that it would not intervene on the slope, meaning that her family remains at risk from the possibility of another landslide. She adds that she is submitting several documents to demonstrate that the Municipalidad de San José has known about the situation for more than 5 years and has done nothing about it.

Drainage systems must be installed on the slope to ensure proper stormwater management, prevent soil saturation, and reduce the risk of further failures. C. The possibility of constructing protective works or carrying out dredging to place rocks along the riverbank should be assessed in order to reduce the effects of lateral erosion. D. To carry out works in publicly owned watercourses, the respective permits must be obtained from the Departamento de Aguas del MINAET and the corresponding Municipalidad; these institutions must therefore be reminded of the urgency of such works so as to facilitate any necessary action. A. Any actions undertaken must be supported by the corresponding technical studies and supervised by a qualified and accredited professional.” (See documentary evidence).
B. The land where the assessment was conducted is located within the micro-watershed (microcuenca) of the río Torres, adjacent to the protection zone (zona de protección) along the left bank. This watercourse (cauce) carries large flow discharges during heavy or extraordinary rainfall in the upper area because it is a principal collector of stormwater, wastewater, and runoff from the upper eastern area of San José. C. The property of Ms. Nombre78921 fronts a public street and is bounded on its northern boundary by the protection zone and canyon of the río Torres, by the municipal park to the east, and by other properties along the remaining boundaries. D. The structures on the assessed land were located more than 10 meters from the edge of the watercourse; this distance has decreased in recent years as a result of erosive action and collapses caused by the flow of the río Torres along both banks, due to extraordinary flooding that causes localized problems.
E. Erosion and undercutting processes are evident on the embankments (taludes) of both banks. On the left bank—the bank of interest adjoining the assessed land—several land collapses have occurred, reducing the distance between the watercourse and the property boundary and increasing the steepness of the embankment. In addition, debris and materials in the riverbed continually divert the flow toward the banks, permanently causing erosion and increasing instability in the area, as well as reducing the hydraulic capacity of the cross-section. F. Vegetation is present along the edge of the watercourse, increasing instability because of the load it places on the soil and the displacement caused by large roots. Some large trees have collapsed into the watercourse because of their considerable weight and erosion at their base. G. At the assessed site, which is owned by Ms. Nombre78921, cracks were found in the soil that indicate instability in the area due to deformation caused by differential settlement (asentamiento diferencial).
However, no cracks or deformations were observed in the residence that might suggest a larger area of instability affecting the structure. Continued erosion and collapses of the río Torres embankment could cause structural problems and eventual collapse. H. On the adjoining property where the municipal park is located, a wall is being constructed parallel to the embankment, very close to the edge and within the protection zone of the río Torres. This structure diverts surface runoff from heavy rainfall toward the boundary adjoining the residence of Ms. Nombre78921, increasing instability and the high susceptibility to collapses throughout the area. VI. Recommendations. A. An adequate system for controlling, collecting, and draining stormwater and surface runoff is recommended for the land owned by Ms. Nombre78921 and the adjoining land where the parque Municipal is located, so that such water is not discharged toward the embankment experiencing stability problems or toward the bank of the watercourse, thereby causing erosion and continual collapses.
B. The setback (retiro) from the río Torres watercourse, defined as the protection zone established under Article N° 33 of Ley Forestal 7575, where buildings and infrastructure are not permitted, must be respected. C. It is recommended that the Municipalidad de San José NOT issue construction permits in the protection areas of rivers, streams, and drainage ditches that drain the canton, or in filled areas, areas with steep slopes, or areas vulnerable to natural hazards. D. Ms. Nombre78921, the Municipalidad de San José, and all residents whose properties adjoin the río Torres watercourse in the assessed section must seek an assessment by a forestry engineer of the trees located along the edge of the watercourse, in order to determine whether they can be pruned or removed as soon as possible to reduce the weight resulting from their location in the area, as they increase soil instability at the site, prior to applying for authorization to cut them and coordinating with the Dirección de Aguas del MINAE.
E. The Municipalidad de San José must provide Ms. Nombre78921 with durable plastic sheeting to be placed on the río Torres embankment, which exhibits cracking and the potential for further collapses, in order to prevent the continual infiltration of stormwater from triggering additional material falls. F. After reducing the weight on the embankment by removing the vegetation that increases instability, Ms. Nombre78921, in coordination with the Municipalidad de San José and all residents whose properties adjoin the río Torres watercourse, must plant low-growing vegetation that increases instability; Ms. Nombre78921, in coordination with the Municipalidad de San José and all residents whose properties adjoin the río Torres watercourse, must plant low-growing, lightweight vegetation with a highly developed root system (such as vetiver), which helps preserve the soil and maintain embankment stability, reducing erosion and material falls.
G. The Municipalidad de San José, in coordination with the affected residents at the assessed site, must apply to the Dirección de Aguas de MINAET for authorization to perform embankment-stabilization works (obras de estabilización del talud) within the watercourse and protection zone of the río Torres, so as to support and stabilize the embankments that are currently unstable and prone to landslides. I. Any construction or stabilization works implemented in the assessed area must be supervised by a professional registered with the Colegio Federado de Ingenieros y Arquitectos de Costa Rica, in accordance with the standards established by the Código Sísmico, Código de Cimentaciones y Reglamento de Construcciones, Código Municipal, and other legislation in force. J. Any irregularity involving construction techniques or failure to comply with the recommendations described herein SHALL BE THE SOLE RESPONSIBILITY of the institutions issuing the permits, the engineer or person responsible for the work, and the respective Municipality if it fails to request the corresponding reports, inspections, and corrective measures.” (See documentary evidence).
Regarding the recommendations of the Final Report, we respectfully indicate: 2.1. Recommendation # -1 Updated report on progress and actions taken in compliance with the CNE recommendations. - Based on the follow-up conducted, compliance with the actions by the Parks and Urban Arboriculture Section is reported (email from Eliecer Alfaro Quesada dated 22-08-2022, with copies to you) concerning the control of surface runoff (escorrentía superficial) from rainwater; construction of a small inspection box (caja de registro) for the discharge of water into the curb-and-gutter drainage channel remains pending and will be carried out shortly. 2.2. Recommendation # 2- Report determining whether the setbacks (retiros) from the río Torres protection zone have been encroached upon. • Official letter DICG-255-2022 concludes that the area of interest corresponds to a protection zone of the río Torres owned by Urbanizadora al Florida S.A., a private entity, and not by this municipal body.
According to the image overlaying registered cadastral plan 51-318375- 1978 on the digitized master plan SI-6863-1969, no encroachment (invasión) upon the protection area by construction is observed, as stated in official letter DICG-286-2022. Regarding the recommendation to demolish the laundry structure, the matter does not fall within the purview of this Office. In response to the inquiry made to Architect Melissa Gómez Salas of Construction Permits, she indicated that the construction permit database contains no permit application for property number 5J-318375-1987 and, regarding the determination of encroachment, recommended that, in compliance with the provisions of Ley Forestal, art.33, INVU be consulted on the matter, as it is the entity that issues opinions concerning river setbacks. 2.3. Recommendation # .3 Submit official letters sent to the Water Directorate of MINAE to obtain the corresponding permits for work in the channel (cauce) of the río Torres.
We consider this recommendation inapplicable, since there is currently no final project for stabilizing the slopes of the municipal park, and such a project remains subject to approval of funding for preliminary studies and to the feasibility of the results. It should be noted that this municipal body is not responsible for obtaining permits for third-party properties. 2.4. Recommendation # 4- Give priority to budgeting funds for studies. • With respect to budgeting resources for soil studies, design, and the cost estimate for the work on municipal property, in accordance with the established institutional process for the 2022 budget closeout, this Office will submit a funding request in enero del año 2023, as appropriate. 2.5. Recommendation # -5 Conduct a new site inspection and clean the channel. • Regarding the recommendation to clean the channel, according to opinion SCMRP-361-2022 issued by the Stormwater Network Construction and Maintenance Section, such cleaning is not required, since river floods will wash away accumulated material and that material does not affect slope stability.
Accordingly, this Office considers the recommendations issued in Technical Report CNE-UIAR-INF-0521-2022 fulfilled within the legal framework and the scope of its authority.” (See documentary evidence).
Regarding stabilization of the municipal park slopes and definition of the project, it is clarified that a project cannot be established without first conducting technical studies. Official letter GPS-OMGRD-178-2022 indicated that a request for funding would be submitted in enero del año 2023 to contract soil studies and mitigation measures (medidas de mitigación) for the municipally owned land, in accordance with the established budget closeout process, with the proviso that the allocation of funds is subject to approval by the Budget Committee. If the funding is approved, the administrative procurement process for the study, planned for the second half of 2023, will proceed. The scope of the study includes soil studies, designs, and cost estimates for the stabilization measures. Once this information is available, the Service Provision Management Office will assess implementation of the work based on the availability of financial resources and the method of execution (either through direct administration, with the implementing unit assigned according to the recommended slope-stabilization measures, or through contracting). 3.
Regarding cleaning of the channel and the accumulation of material in the río Torres channel, the technical opinion issued by the Stormwater Network Maintenance and Construction Section is maintained: the accumulated material does not affect slope stability and, given the fluvial dynamics (dinámica fluvial), it is liable to be carried away and does not require removal. It is also clarified that channelization processes involving publicly owned channels and/or the containment or correction of natural erosion processes associated with the fluvial dynamics of rivers do not fall within this institution’s authority. Risk reduction is a matter of shared responsibility, under which private parties are also responsible for knowing the existing hazards in the surroundings of their habitat and taking action to secure their property.” (See documentary evidence).
IV.Regarding the specific case. In the case under review (sub iudice), the petitioner (accionante) states that, in 2017, due to a severe rainy season, several landslides (deslizamientos) began near the municipal park adjacent to her property. She asserts that one of those landslides was approximately 50 meters from her property. Because of that situation, she appeared before the Comisión Nacional de Emergencias and the Municipalidad de San José, requesting that those bodies address the landslide because, if it continued, it would affect her property. She mentions that the municipality told her that the area had to be reforested, which was done; nevertheless, in 2022, due to heavy rains, the landslide occurred again, this time causing more land to give way and creating an enormous hole that is now barely 1 meter from reaching the rear of her house. Consequently, she again approached the Comisión Nacional de Emergencias and the Municipalidad de San José.
She asserts that the municipality provided her with a plastic sheet that does not cover even one-fourth of the landslide. Likewise, the Comisión Nacional de Emergencias recommended the following: “a) stabilize the slope (talud) as part of the responsibilities of the Municipalidad de San José; b) cut down the trees and plant ‘vertivery C’ grass; c) construct drainage channels so that the water drains toward the front of the park and not toward the slope.” She adds that she received no response from the municipality, and therefore had to approach the Defensoría de los Habitantes; following its intervention, the municipality stated that it would not intervene on the slope, meaning that her family remains at risk from the possibility of another landslide. She adds that she submits several documents to demonstrate that the Municipalidad de San José has known about the situation for more than 5 years and has done nothing about it.
As a starting point, the Chamber (Sala) recalls its case law (jurisprudencia) regarding municipal authority (competencias municipales) and the need for interinstitutional coordination (coordinación interinstitucional):
“IV.- MUNICIPAL AUTHORITY AND DUTY OF INTERINSTITUTIONAL COORDINATION. Municipal authority and duty of interinstitutional coordination. Article 169 of the Constitución Política provides that ‘The administration of local interests and services in each canton shall be the responsibility of the Municipal Government (...).’ This provision has been developed by the ordinary legislature; accordingly, Article 3 of the Código Municipal, Ley N° 7794 de 30 de abril de 1998, provides that: ‘The governance and administration of cantonal interests and services shall be the responsibility of the municipal government.’ The Sala Constitucional has expressed the same view in its case law. For example, Sentencia N° 5445-99, de las 14:30 horas del 14 de julio de 1999, held as follows:
‘VI.- THE POWERS OF MUNICIPALITIES BY SUBJECT MATTER (THE CONCEPT OF “LOCAL MATTERS”). By express constitutional provision—Article 169—functions or powers concerning “local matters” are assigned to local governments by subject matter, that is, “the administration of the services and interests” of the locality within their jurisdiction, for which purpose they are granted autonomy (”). Accordingly, their powers are general, insofar as there is no detailed enumeration of their particular duties, but merely a statement of the scope of their authority; this does not, however, mean that such authority cannot be determined, as this Court observed in sentencia número 6469-97, de las dieciséis horas veinte minutos del ocho de octubre de mil novecientos noventa y siete, in the following terms:
‘(...) local matters have such a character that defining their scope, whether by the legislature or by a judge, must preserve the integrity of local interests and services. Thus, not even the legislature could enact rules intended to dismember the Municipality (the territorial element) without following the procedures previously established in the Constitución Política; nor could it enact rules that place its inhabitants (the population) in conditions of clear inferiority relative to the rest of the country, or rules that affect the very essence of local governance (the government), turning the Corporation into a mere empty vessel that retains only its name while dismantling the entire system as conceived by the Asamblea Nacional Constituyente. Put differently, there are duties that, by their nature, are municipal—local—and cannot be removed from that sphere of authority and converted into national services or interests, because doing so would dismantle the Municipality or, more precisely, deprive it of its constitutional substance.
It is therefore impossible to establish in advance the inviolable boundaries of local matters; instead, determining what does or does not fall to communal government must arise from an examination of each specific case (...).’ It follows from the foregoing that, by the express will of our Fundamental Charter, specific authority is assigned to local governments, and that authority is also exclusive to them; in other words, it is an inherent authority (competencia originaria) of the municipality and may be displaced, in whole or in part, only through a nationalization or regionalization law.’ Consequently, if a group of municipal residents (munícipes), within their territorial jurisdiction, suffer flooding that endangers their lives and causes serious property damage, psychological harm, and harm to their quality of life and general well-being, this falls within the concept of ‘local interests and services’ under constitutional Article 169.
The causes of such problems must be precisely identified and, even more importantly, so must the solutions, so that they may be implemented as soon as possible; for that purpose, the Municipality must coordinate with the national-level institutions that have authority to address the problem. Indeed, the Chamber has already developed the municipal duty to coordinate with other state institutions in order to safeguard local ‘interests’ and properly provide ‘local services.’ In the aforementioned Sentencia N° 5445-99, the Chamber stated:
‘(...) they concern the duty of coordination that must exist among local governments, decentralized institutions, and the Executive Branch in carrying out the functions entrusted to them, which must be analyzed on the basis of the very nature of municipal autonomy. By virtue of Article 170 of the Constitution, municipalities (local corporate entities) enjoy functional, administrative, and financial autonomy in the administration of local interests and services (Article 169 of the Constitución Política) (...). A conflict therefore cannot be created through antagonism or competition for prominence between the subject matter encompassed by the general purpose of “local interests and services” and “national” or “state” public interests and services, which are intrinsically distinct from one another but are, in fact, intended to coexist (....). Once the municipality’s subject-matter authority within a particular territorial jurisdiction has been defined, it is clear that some duties will, by their nature, be exclusively municipal, alongside others that may be deemed national or state duties.
It is therefore essential to define the inevitably shared exercise of powers, because the public capacity of municipalities is local, while that of the State and other entities is national; it follows that municipal territory is simultaneously state and institutional territory to the extent required by the circumstances. In other words, municipalities may share their authority with the Public Administration in general, a relationship that must operate under the terms defined by law (Article 5 of the former Código Municipal, Article 7 of the new Código), which establishes a duty of “coordination” between municipalities and the public institutions involved in exercising their respective authority, in order to avoid duplication of effort and contradictions, particularly because only voluntary coordination is compatible with municipal autonomy, as it is an expression thereof. In other words, the municipality is called upon to enter into cooperative relationships with other public entities, and vice versa, given that their interests concerning a particular matter are, in many cases, concurrent or overlapping.
In legal scholarship, coordination is defined on the basis of the existence of several independent centers of action, each having its own duties and decision-making powers, which may sometimes conflict; despite this, there must be a commonality of purposes according to subject matter, arising from their concurrence, insofar as they share the object that receives the final results of each entity’s activities and acts.’ Coordination is therefore the ordering of the relationships among these various independent activities, taking into account their concurrence upon the same object or entity, so as to make it useful to an overall public plan without eliminating the reciprocal independence of the acting entities. Because there is no hierarchical relationship among decentralized institutions, or between the State itself and municipalities, specific conduct cannot be imposed upon municipalities.
This gives rise to the indispensable interinstitutional ‘concerted action,’ in the strict sense, whereby the autonomous and independent centers of action agree upon that preventive and comprehensive framework, within which each performs a role in furtherance of a mission entrusted to the others.’ It should also be noted that Municipalities are required, by mandate of Article 50 of the Constitución Política, to devote themselves to protecting the environment (sentencia n.° 2006-7994 de las 8:57 horas de 2 de junio de 2006)” (sentencia n.° 2020-10630 de las 9:15 horas del 12 de junio de 2020).
Now, in the case under review (sub examine), it has been verified that, in 2017, the petitioner (accionante) filed a complaint with the Municipalidad de San José regarding a landslide (deslizamiento) on municipal land adjacent to her residence. The matter was assigned incident n.° 2017-09-28-01596. The home occupied by the amparo petitioner (amparada) is located at the edge of the slope along the left bank of the río Torres and, during rainy periods, is affected by soil failures, compounded by the lateral erosion caused by the river. The instability process affects the land adjoining the municipal park, the home of Ms. Nombre78921, other properties located along the riverbank in Urbanización Florida Norte, and the park itself. The instability problem was exacerbated by the construction of the highway to Tibás, when the channel was culverted and diverted in the decade of the 90s. The Comité Municipal de Emergencia de San José, in a report dated 30 de setiembre de 2017, determined: “•CNE: request for a risk assessment due to land instability and an assessment of the safety of house #D-1, the children’s playground, the sports-court area, and neighboring homes. •MSJ: Assessment of municipal land and human safety, and mitigation measures concerning the perimeter fence.
Assessment of measures to stabilize the municipal land adjacent to house # . •Forwarding of the report to the Area (sic) Rectora de Salud Merced, mbre9687 y y la Uruca, within the scope of its authority. •For the population: surveillance and monitoring of landslide activity.” On 2 de octubre de 2017, the CNE was asked to conduct a visual risk assessment in Urbanización La Florida Norte following the collapses that had occurred on the right bank of the río Torres. This was addressed through technical report IAR-INF-1008-2017 of 2017, entitled: “Risk Assessment of Urbanización Florida Norte Due to Slope Instability and Landslide.” That document determined: “V. Conclusions A. The oversaturation of the ground caused by the heavy rains, together with lateral erosion from the river, is what apparently triggered the material failure. B. The home next to the slope is at risk because its proximity to the edge could result in direct damage if further failures occur in the future.
C. If mitigation measures are not undertaken in the river and on the hillside, further failures could occur and directly affect the structures of the homes and the park in the future, especially during extraordinary weather events. VI. Recommendations A. The residents whose properties adjoin the slope must be informed of the risk so that they remain alert for further failures and are vigilant during extraordinary weather events, allowing them to take preventive measures in time; particularly Ms. mbre78921 q, whose risk is greater because of the proximity to the slope. B. Drainage systems must be installed on the slope to ensure proper stormwater management, prevent soil saturation, and reduce the risk of further failures. C. The possibility of constructing a protective structure or performing dredging to place rocks along the riverbank should be assessed in order to reduce the effects of lateral erosion.
D. To undertake works in publicly owned channels, the respective permits must be obtained from the Departamento de Aguas del MINAET and the corresponding Municipality; these institutions should therefore be reminded of the urgency of the works so as to facilitate any necessary action. A. The actions undertaken must be supported by the corresponding technical studies and supervised by a qualified and accredited professional.” Furthermore, the Chamber notes that, in 2022, the petitioner again reported that the problem persisted; consequently, the head of the Oficina Municipal de Gestión de Riesgo a Desastres de la Municipalidad de San José asked the CNE to conduct a visual and qualitative assessment of the land located at Dirección50, on the left bank of the río Torres. Accordingly, through technical report CNE-UIAR-INF-0521-2022 dated 30 de mayo de 2022, the CNE conducted the “Risk Assessment of Land at Dirección4834 Due to Lateral Erosion and Hillside Instability on the Left Bank of the río Torres.” That document determined: “V.
Conclusions A. According to the CNE’s Mapa de Amenazas Naturales Potenciales, the assessed land on which the municipal park and the home of Ms. Nombre78921 are located lies within the zone affected by flash flooding of the río Torres, which has the potential to cause waterlogging and lateral erosion along its banks. On the land in question, the principal problems are hillside instability caused by the undercutting process produced by the flow dynamics along the banks, and erosion resulting from improper management of surface runoff. B. The land under assessment is located within the río Torres micro-watershed, adjoining the protection zone (zona de protección) on the left bank. This channel carries large flows when heavy or extraordinary rainfall occurs in the upper area because it is a principal collector of stormwater, wastewater, and runoff from the upper eastern area of San José. C. Ms.
Nombre78921’s property fronts a public road; its northern boundary adjoins the protection zone and canyon of the río Torres, it adjoins the municipal park to the east, and other properties along its remaining boundaries. D. The structures on the assessed land were located more than 10 meters from the edge of the channel; this distance has decreased in recent years as a result of the erosive action and failures caused by the flow of the río Torres along both banks, due to extraordinary flooding that causes localized problems. E. Erosion and undercutting processes can be observed on the slopes of both banks. On the left bank—the bank of interest adjoining the assessed land—several ground collapses have occurred, reducing the distance between the channel and the property boundary and increasing the steepness of the slope. In addition, rubble and other materials in the channel bed constantly divert the flow toward the banks, causing permanent erosion, increasing instability in the area, and reducing the hydraulic capacity of the cross-section.
F. Vegetation is present along the edge of the channel, increasing instability because of the load it places on the soil and the displacement caused by large roots. Some large trees have collapsed into the channel because of their considerable weight and erosion at their bases. G. At the assessed site, owned by Ms. Nombre78921, cracks were found in the soil indicating instability in the area due to deformation caused by differential settlement. However, no cracks or deformations were observed in the home that might suggest a larger unstable area endangering the structure. Continued erosion and failures of the río Torres slope could cause structural problems and eventual collapses. H. On the adjoining property where the municipal park is located, a wall has been constructed parallel to the slope, very close to the edge and within the río Torres protection zone. This structure diverts surface runoff from heavy rainfall toward the boundary with Ms.
Nombre78921’s home, increasing the conditions of instability and the high susceptibility to failures throughout the area. VI. Recommendations. A. An adequate system for controlling, collecting, and draining stormwater and surface runoff is recommended for the land owned by Ms. Nombre78921 and the adjoining land where the municipal park is located, so that such waters are not discharged toward the slope experiencing stability problems and the bank of the channel, thereby causing erosion and constant failures. B. The setback distance (retiro) from the río Torres channel, defined as the protection zone established pursuant to artículo N° 33 of Ley Forestal 7575, must be observed; no buildings or infrastructure are permitted within that zone. C. It is recommended that the Municipalidad de San José NOT issue construction permits for the protection areas of rivers, streams, and irrigation ditches that drain the canton, or for filled areas, steep slopes, or areas vulnerable to natural hazards.
D. Ms. Nombre78921, the Municipalidad de San José, and all residents whose properties adjoin the río Torres channel in the assessed section must obtain an assessment by a forestry engineer of the trees located along the edge of the channel, in order to determine whether they can be pruned or removed as soon as possible to reduce the weight resulting from their location in the area, as they increase soil instability at the site, after applying for authorization to cut them and coordinating with the Dirección de Aguas del MINAE. E. The Municipalidad de San José must provide Ms. Nombre78921 with durable plastic sheeting to be placed on the río Torres slope, which shows cracking and the potential for further collapses, in order to prevent the constant infiltration of stormwater from triggering additional material falls. F. Once weight has been removed from the slope by removing vegetation that increases instability, Ms.
Nombre78921, in coordination with the Municipalidad de San José and all residents whose properties adjoin the río Torres channel, must plant low-growing vegetation that increases instability; Ms. Nombre78921, in coordination with the Municipalidad de San José and all residents whose properties adjoin the río Torres channel, must plant low-growing, lightweight vegetation with a highly developed root system (such as vetiver), which helps preserve the soil and maintain slope stability, reducing erosion and material failures. G. The Municipalidad de San José, in coordination with the affected residents at the assessed site, must apply to the Dirección de Aguas de MINAET for a permit to carry out slope-stabilization works in the channel and protection zone of the río Torres, so as to support and stabilize slopes that are currently unstable and prone to landslides. I. Any construction or stabilization works implemented in the assessed area must be supervised by a professional affiliated with the Colegio Federado de Ingenieros y Arquitectos de Costa Rica, in accordance with the standards established by the Código Sísmico, Código de Cimentaciones y Reglamento de Construcciones, Código Municipal, and other legislation in force.
J. Any anomaly involving construction techniques or any failure to follow the recommendations described herein SHALL REMAIN THE SOLE RESPONSIBILITY of the institutions issuing the permits, the engineer or person responsible for the works, and the respective Municipality if it fails to request the corresponding reports, inspections, and corrections.” For her part, precisely because the respondents did not resolve the problem that is the subject of this proceeding, on 27 de junio de 2022 the appellant filed a complaint with the Defensoría de los Habitantes, requesting its intervention so that the Municipalidad de San José would carry out the work recommended by the Comisión Nacional de Emergencias. By official letter n.° 06696-2022-DHR of 6 de julio de 2022, the Defensoría de los Habitantes forwarded the protected party’s petition and requested a report from the Municipalidad de San José. By official letter n.° 07906-2022-DHR of 10 de agosto de 2022, the Defensoría de los Habitantes issued its final report and recommended: “1.
Submit an updated report on the progress made and actions taken to comply with the recommendations issued by the CNE in technical report N° CNE-UIAR-0521-2022 dated 30 de mayo del 2022. 2. Submit the report resulting from the inspection conducted to determine whether the setbacks (retiros) from the protection zone (zona de protección) of the río Torres have been encroached upon, as well as the actions that will be taken in that regard if irregularities are found. 3. Submit the official letters issued by that municipal government requesting from the Dirección de Aguas del MINAE the corresponding permits for work that must be carried out in the riverbed (cauce) of the río Torres. 4. Allocate, as a matter of priority, funds for the soil study, design, and budget for the work to be performed in the riverbed of the río Torres. 5. Conduct a new inspection of the site and clean the riverbed so that the debris and materials found therein (despite being limited in quantity) do not cause further instability along the riverbanks.” By official letter GPS-OMGRD-178-2022 of 22 de agosto de 2022, the head of the Oficina Municipal Gestión de Riesgo a Desastres of the Municipalidad de San José stated: “In response to official letters DAJ-1960-2022, DAJ-1961-2022 and ALCALDIA-02016-2022 concerning the Final Report of Recommendations of the Defensoría de los Habitantes regarding the complaint filed by Ms.
Nombre78921 due to instability of the río Torres slope, I hereby report the following: 1. In view of the threat posed by erosion and scouring (socavamiento) of the left bank slope of the río Torres, and the vulnerability of public infrastructure (municipal park) and private property (the home of Ms. Nombre78921, cadastral plan (plano catastro) SJ-318375-1978), and as a follow-up to Technical Report CNE-UIAR-INF-0521-2022, this Office established an action plan to comply with the recommendations issued by CNE. The activities under the plan are limited solely to municipally owned land and do not contemplate intervention on private land, given the institution’s authority and the scope of intervention in protection zones of bodies of water and/or on private property. 2. With respect to the recommendations in the Final Report, we respectfully state: 2.1. Recommendation # -1 Updated report on progress and actions taken to comply with CNE recommendations. - According to the follow-up conducted, the Sección Parques y Arboricultura Urbana reports compliance with actions relating to the control of surface runoff (escorrentía superficial) from rainwater (email from Eliecer Alfaro Quesada dated 22-08-2022, copied to you), with only the construction of a small inspection chamber (caja de registro) for the discharge of water into the curb and gutter (cordón de caño) remaining pending and scheduled to be carried out shortly. 2.2.
Recommendation # 2- Report determining whether the setbacks from the río Torres protection zone have been encroached upon. • Official letter DICG-255-2022 concludes that the area in question is part of a protection zone of the río Torres owned by Urbanizadora al Florida S.A., a private party, and not by this municipal entity. According to the image overlaying registered cadastral plan 51-318375- 1978 on the digitized master plan SI-6863-1969, no encroachment upon the protection area by construction is observed, as stated in official letter DICG-286-2022. With respect to the recommendation to demolish the laundry structure, the matter does not fall within the jurisdiction of this Office. In response to an inquiry made to Architect Melissa Gómez Salas of Permisos de Construcción, she indicated that the construction-permit database contains no permit application for property number 5J-318375-1987; regarding the determination of encroachment, and in compliance with the provisions of Ley Forestal, art.33, it is recommended that INVU, the entity that issues opinions concerning river setbacks, be consulted on this matter. 2.3.
Recommendation # .3 Submit official letters sent to the Dirección de Agua del MINAE regarding the corresponding permits for work in the riverbed of the río Torres. We consider this recommendation inapplicable because there is currently no final project for stabilization of the slopes (estabilización de laderas) of the municipal park, and such a project remains subject to approval of resources for contracting preliminary studies and to the feasibility of the results. It should be noted that this municipal entity is not responsible for obtaining permits for third-party properties. 2.4. Recommendation # 4- Priority allocation of funds for studies. • With respect to budgeting resources for the soil studies and for the design and budget of the work on municipal property, in accordance with the established institutional process for the 2022 budget closeout, this Office will submit a request for resources in enero del año 2023, as appropriate. 2.5.
Recommendation # -5 Conduct a new inspection of the site and clean the riverbed. • With respect to the recommendation to clean the riverbed, according to opinion SCMRP-361-2022 issued by the Sección de Construcción y Mantenimiento de Red Pluvial, such cleaning is unnecessary because river flooding will wash away accumulated material and that material does not affect slope stability. Accordingly, this Office considers the recommendations issued in Technical Report CNE-UIAR-INF-0521-2022 to have been fulfilled within the framework of the legal system and the scope of its authority.” By official letter GPS-OMGRD-198-2022 of 8 de setiembre de 2022, the head of the Oficina Municipal de Gestión de Riesgo a Desastres and the manager of Provisión de Servicios, both of the Municipalidad de San José, stated: “In response to your official letters DAJ-2178-30-2022 andDAJ-2180-30-2022, concerning the Final Report of Recommendations issued by the Defensoría de los Habitantes regarding the case submitted by Ms.
Nombre78921 due to instability of the río Torres slope and the request for additional information, we state the following: 1 The construction of an inspection chamber is the responsibility of the Sección de Parques y Arboricultura Urbana, and the section has been instructed regarding this matter. According to inquiries made of the engineers responsible for this action, Raúl Acosta Solorzano and Eliecer Alfaro Quesada, the pending work (filling, grassing, and construction of the inspection chamber) is scheduled to be completed during the period between 19 and 30 de setiembre 2022. 2. Regarding stabilization of the municipal park slopes and definition of the project, it is clarified that a project cannot be established without first conducting technical studies. Official letter GPS-OMGRD-178-2022 indicated that a request for resources would be submitted in enero del año 2023 for the procurement of soil studies and mitigation measures (medidas de mitigación) for the municipally owned land, in accordance with the established budget-closeout process, with the proviso that the allocation of resources is subject to approval by the Comisión de presupuesto.
If the resources are approved, the administrative procurement (contratación administrativa) process for the study planned for the second half of 2023 will proceed. The scope of the study includes soil studies, designs, and budgets for the stabilization measures. Once this information is available, Gerencia de Provisión de Servicios will assess implementation of the work based on the availability of financial resources and the method of execution (whether through direct administration, assigning the implementing unit according to the recommended slope-stabilization measures, or through contracting). 3. With respect to cleaning the riverbed and the accumulation of material in the riverbed of the río Torres, the technical opinion issued by the Sección de Mantenimiento y Construcción de Red Pluvial—that the accumulated material does not affect slope stability and, given the fluvial dynamics (dinámica fluvial), is susceptible to being carried away and need not be removed—is maintained.
It is further clarified that channelization processes (canalización de cauces) involving publicly owned riverbeds and/or the containment or correction of natural erosion processes associated with the fluvial dynamics of rivers do not fall within the authority of this institution. Risk reduction is also a matter of shared responsibility, under which private parties are likewise responsible for being aware of existing hazards in the surroundings of their homes and taking action to safeguard their property.” By official letter 09838-2022-DHR of 1° de octubre de 2022, the Defensoría de los Habitantes requested that the Municipalidad de San José clarify the following: “In view of the foregoing, you are requested to clarify the following points in detail and submit the documents indicated below: 1. The aforementioned official letter states that construction of the outstanding inspection chamber would be completed between 19 and 30 de setiembre of this year.
Has that work now been completed? 2. If your answer is no, please state the reasons for the delay and indicate when completion is projected. 3. How often are the park’s trees and vegetation maintained? Please submit its maintenance program.” By official letter SPAU-587-2022 of 5 de octubre de 2022, the acting head of the Sección de Parques y Arboricultura Urbana of the Municipalidad de San José stated: “With reference to the request for an assessment of the case described in official letter DAJ-2444-30-2022, Expediente 256536, I hereby provide information regarding the matters raised that fall within the authority of the Sección de Parques: 1. Report on the completion of construction of the inspection chamber scheduled between 19 and 30 de setiembre. The inspection chamber has been constructed, and only installation of the grate remains outstanding; that work is scheduled to be performed on 12 de octubre of this year by Engineer Eliécer Alfaro Quesada. 2.
Provide the maintenance schedule for the park’s trees and vegetation. The park area, like all areas served by the section in the outlying areas of the canton, is serviced monthly, during which the green areas are cleaned and maintained and minor pruning requiring preventive maintenance is performed. If more complex pruning is required, the matter is referred to Engineer Randall Ramírez for scheduling along the route for this type of intervention; however, he has instructed that periodic visits be made to the area to assess the condition of the trees and the need for interventions of this kind.” The Office of the Ombudsperson (Defensoría de los Habitantes), by official letter 12287-2022-DHR dated December 2, 2022, requested that the Municipalidad de San José clarify the following: “1. The aforementioned official letter indicates that the missing inspection box (caja de registro) had already been completed and that only the grate remained to be installed, which was scheduled for October 12.
Has that grate already been installed? 2. In a telephone conversation with the complainant, she stated that the inspection box is not functioning properly and that water pools in it. Please conduct an inspection to determine whether it is functioning properly and inform the Defensoría accordingly. 3. How often are the park’s trees and vegetation maintained? Please provide its maintenance schedule beyond September of this year, which was the last date reported to the Defensoría.” The professional from the Área Forestal and the person in charge of the Proceso de Obra Civil of the Municipalidad de San José, by official letter SPAU-0754-2022 dated December 9, 2022, stated: “1. The grate has been installed correctly (Figure 1). 2. The base of the inspection box holds a certain amount of water and the sediment carried by the rain so that it may be collected afterward, and its proper operation will be verified during the next rainy season. 3.
Maintenance of the park’s green areas: performed once a month. Tree pruning: Tree maintenance is performed once a year (in July); it should be noted that pruning work was scheduled for December 08 and 9 of the current year in the park in question on the following trees: Llama del Bosque, Sota Caballo, Dama, Aguacate, and Moringa. This was done for the purpose of clearing the public lighting and power lines and raising the crowns of these species.” Based on these facts, the Chamber has sufficient certainty to find that the reported problem exists, is known to the respondent authorities (autoridades recurridas), and has not been resolved in approximately six years.
It should thus be recalled that this Court has a duty to protect the life and physical integrity of persons and, where appropriate, to compel government bodies to safeguard those rights. In the case at hand, the Chamber considers it undeniable that the respondent party’s omission affected the rights of the petitioner and the other residents affected by the slope, because their lives and physical integrity were unnecessarily allowed to remain at risk despite warnings that have been issued for years. In light of the foregoing, the amparo petition (recurso) is granted, with the consequences set forth in the operative portion (parte dispositiva) of this judgment.
V.Note by Justice Castillo Víquez regarding prompt and effective administrative justice (justicia administrativa pronta y cumplida). I have supported this Court’s position that when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the legal dispute must be heard by the Contentious-Administrative Courts (Tribunales de lo Contencioso-Administrativo), rather than by this Chamber. However, with the recent enactment of Law No. 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the amparo proceeding (recurso de amparo) established under Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights.
In my view, the newly enacted legislation does not require this Court to modify its line of precedent, since, under section 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Accordingly, except for those legal-constitutional disputes (controversias jurídico-constitucionales) that this Chamber itself has recognized as exceptional circumstances and that may indeed be heard in this jurisdiction through the constitutional amparo guarantee proceeding, all other cases fall within the jurisdiction of the judges of the contentious-administrative jurisdiction (jurisdicción de lo contencioso-administrativo), for the reasons given by this Court (Judgment No. 2008-02545 at 8:55 a.m. on February 22, 2008). All of the foregoing is consistent with section 25 of the Convención Americana sobre Derechos Humanos, Constitutional Law (Derecho de la Constitución) (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
VI.Documents submitted to the case file (expediente). The parties are hereby advised that if they submitted any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the Court Clerk’s Office within no more than 30 business days from service of this judgment. Otherwise, any material not retrieved within that period shall be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session number 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session number 43-12 held on May 3, 2012, Article LXXXI.
Por tanto:
The amparo petition is granted. Johnny Araya Monge and Lorena Romero Vargas, respectively, mayor and head of the Oficina de Gestión de Riesgo a Desastres, both of the Municipalidad de San José, as well as Alejandro José Eduarte, in his capacity as president of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, or whoever may hold those offices, are ordered to do the following: 1.- coordinate whatever is necessary to assess the need for and, where appropriate, implement an interim protective measure (medida cautelar) to safeguard the life and physical integrity of the persons affected by the slope at issue in these proceedings, within FIVE BUSINESS DAYS from service of this judgment; 2- form a commission to assess the case and determine a final solution that is technically and legally appropriate. In complying with this requirement, a schedule must be established for implementing that solution.
All of the foregoing must be completed within ONE MONTH from service of this judgment; 3- comply with the schedule specified in the preceding paragraph. The respondent authorities are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that they must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de San José and the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias are ordered to pay the legal costs, damages, and losses caused by the events forming the basis of this ruling, the amounts of which shall be determined during enforcement of the judgment before the contentious-administrative jurisdiction. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veintisiete de enero de dos mil veintitres .
Recurso de amparo que se tramita en expediente n.° 22-028814-0007-CO, interpuesto por Nombre78921, cédula de identidad CED45590, contra la MUNICIPALIDAD DE SAN JOSÉ y la COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS (CNE).
Resultando:
Redacta el Magistrado Cruz Castro; y,
Considerando:
I.Sobre la excepción del artículo 41 de la Constitución Política. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia n.° 2008002545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la Administración Pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante una denuncia por un talud que pone podría poner en eventual riesgo la vida e integridad de la parte recurrente, la cual se acusa que no ha sido resuelta dentro de un plazo razonable. Aclarado el punto, se entra a resolver la situación concreta reclamada en este amparo.
II.Objeto del recurso. La accionante manifiesta que, en el 2017, debido a un fuerte invierno, iniciaron varios deslizamientos cerca del parque municipal contiguo a su propiedad. Asegura que uno de esos deslizamientos estaba aproximadamente a 50 metros de su propiedad. Por esa situación, se apersonó en la Comisión Nacional de Emergencias y a la Municipalidad de San José, instancias ante las que solicitó que se interviniera ese deslizamiento, pues si continuaba iba a afectar su propiedad. Menciona que en la municipalidad le indicaron que debía reforestar esa zona, situación que realizaron; no obstante, en el 2022, debido a las fuertes lluvias, se volvió a dar el deslizamiento, esta vez cediendo más terreno y provocando un hueco enorme que ya está a escaso 1 metro de llegar a la parte trasera de su casa. Por ende, acudió nuevamente a la Comisión Nacional de Emergencias y a la Municipalidad de San José.
Asegura que de la municipalidad recibió un plástico que no abarca ni una cuarta parte del deslizamiento. Asimismo, la Comisión Nacional de Emergencias recomendó lo siguiente: “a) estabilizar el talud como parte de las responsabilidades de la Municipalidad de San José; b) cortar los árboles y sembrar zacate tipo "vertivery C"; c) hacer unos caños para que las aguas drenen hacia el frente del parque y no hacia el talud”. Añade que no recibió respuesta por parte de la Municipalidad, por lo que tuvo que acudir a la Defensoría de los Habitantes y ante su intervención la municipalidad expresó que no iba a intervenir el talud, por lo que su familia sigue en riesgo ante la posibilidad de un nuevo deslizamiento. Agrega que presenta varios documentos para evidenciar que desde hace más de 5 años la Municipalidad de San José conoce la situación y no ha hecho nada al respecto.
B. Se debe realizar sistemas de drenaje sobre el talud para garantizar el buen manejo de las aguas pluviales para evitar la saturación de los suelos y disminuir el riesgo de más desprendimientos. C. Se debe valorar la posibilidad de realizar una obra de protección o dragado para colocar rocas en la margen del rio para disminuir los efectos de la erosión lateral. D. Para realizar unas obras en causes de dominio público, se debe contar con los permisos respectivos del Departamento de Aguas del MINAET y de la Municipalidad correspondiente; por lo que se debe recordar a estas instituciones de la urgencia de estas para facilitar cualquier gestión. A. Las acciones que se realicen deben estar respaldadas por los estudios técnicos correspondientes y ser supervisadas por un profesional de competencia y acreditado”. (Ver prueba documental).
Este cauce posee grandes descargas de caudal cuando se presentan lluvias fuertes o extraordinarias en la parte alte, debido a que es un colector principal de aguas pluviales, servidas y de escorrentía de la zona alta del este del San José. C. La propiedad de la señora Nombre78921 posee frente a calle pública, colinda en su lindero norte con la zona de protección y cañón del río Torres, con el parque municipal del este y con otras propiedades en los límites restantes. D. Las infraestructuras presentes en el terreno evaluado estaban retiradas más de 10 metros al borde del cauce, esta distancia se ha reducido en los últimos años como resultado de la acción erosiva y desprendimientos provocados por el caudal del río Torres sobre ambas márgenes, debido a las crecidas extraordinarias que generan problemas localizados. E. Se observan procesos erosivos y de socavamiento en los taludes de ambas márgenes, sobre la margen izquierda; margen de interés con la que colinda el terreno evaluado, se han generado varios colapsos de terreno reduciendo la distancia del cauce con el límite de la propiedad y aumentado la verticalidad del talud.
Además, existen escombros y materiales en el lecho del cauce que desvían constantemente el caudal hacia las márgenes, generando permanentemente erosión e incrementando la inestabilidad del sector, así como la reducción de la capacidad hidráulica de la sección. F. En la zona existe vegetación en el borde del cauce, la cual aumenta la inestabilidad debido a la carga que ejerce sobre el suelo y a la remoción que propician las raíces de gran tamaño. Algunos árboles de gran tamaño han colapsado hacia el cauce por su gran peso y la erosión a la base. G. En el sitio evaluado, propiedad de la señora Nombre78921, se evidenciaron agrietamientos en el suelo que muestren una inestabilidad del sector debido a problemas de deformación por el asentamiento diferencial. Sin embargo, en la vivienda no se observan grietas o deformaciones que podrían sugerir una mayor área de inestabilidad que comprometa la estructura.
La continua erosión y desprendimientos del talud del río Torres podrían generar problemas en la estructura y eventuales colapsos. H. En propiedad aledaña donde se ubica el parque municipal se observa construcción de un muro paralelo al talud muy cercano al borde y dentro de la zona de protección del río Torres. Esta obra desvía las aguas de escorrentía superficial; caídas durante lluvias intensa, hacia la colindancia con la vivienda de la señora Nombre78921, aumentando las condiciones de inestabilidad y alta susceptibilidad a desprendimientos en todo el sector. VI. Recomendaciones. A. Se recomienda en el terreno propiedad de la señora Nombre78921 y el colindante donde está el parque Municipal, un sistema adecuado para el control, la recolección y el drenaje de aguas pluviales y escorrentía superficial, para que estas no sean descargadas hacia el talud con problemas de estabilidad y la margen del cauce, generando erosión y de desprendimientos constantes, B. Se debe respetar la distancia del retiro al cauce del rio Torres, la cual está definida como la zona de protección, establecida según el artículo N° 33 de la Ley Forestal 7575, donde no se permiten construcciones o infraestructuras.
C. Se recomienda a la Municipalidad de San José NO brindar permisos de construcción en las áreas de protección de ríos, quebradas y acequias que drenan el cantón; así como en áreas de relleno, fuertes pendientes o vulnerables a las amenazas naturales. D. La señora Nombre78921, Municipalidad de San José y todos aquellos vecinos colindantes con el cauce del río Torres en la sección evaluada, deberán buscar la evaluación parte de un ingeniero forestal de los árboles que se ubican en el borde el cauce, para establecer la posibilidad de derramar o eliminar lo más pronto posible estos con el fin de quitar peso debido a su ubicación en el sector, los cuales aumentan la inestabilidad del suelo en el sitio, previo a la solicitud de corta y coordinación ante la Dirección de Aguas del MINAE. E. La Municipalidad de San José deberá facilitar a la señora Nombre78921 plástico resistente para que sea colocado en el talud del río Torres; el cual presenta agrietamientos y potencial de nuevos colapsos, con el fin de evitar la constante infiltración de aguas pluviales que dispare nuevas caídas de material.
F. Habiendo quitado peso al talud con la remoción de la vegetación que aumenta la inestabilidad, la señora Nombre78921 en coordinación con la Municipalidad de San José y todos aquellos vecinos colindantes con el cauce del río Torres, deberán colocar vegetación de poca altura que aumenta la inestabilidad, la señora Nombre78921 en coordinación con la Municipalidad de San José y todos aquellos vecinos colindantes con el cauce del río Torres, deberán colocar vegetación de poca altura y peso con gran desarrollo de sistema radial (tipo vetiver), que ayuda a la preservación del suelo y mantenga la estabilidad en el talud, disminuyendo la erosión y desprendimientos de material. G. La Municipalidad de San José en coordinación con los vecinos afectados en el sitio evaluado, deberán solicitar ante la Dirección de Aguas de MINAET el permiso para realizar obras de estabilización del talud en el cauce y zona de protección del rio Torres, las cuales permitan dar soporte y estabilidad a los taludes que se encuentran actualmente inestables y propensos a deslizamientos.
I. Las obras constructivas o de estabilización que se implementen en la zona evaluada deben ser supervisadas por un profesional agremiado al Colegio Federado de Ingenieros y Arquitectos de Costa Rica, con base en las normas establecidas por el Código Sísmico, Código de Cimentaciones y Reglamento de Construcciones, Código Municipal y otra legislación vigente. J. Cualquier anomalía en cuanto a técnicas de construcción u omisión a las recomendaciones aquí descritas, QUEDA BAJO TOTAL RESPONSABILIDAD de las instituciones que otorgan los permisos, del ingeniero o responsable de la obra y de la Municipalidad respectiva de no solicitar los informes, inspecciones y correcciones correspondientes”. (Ver prueba documental).
En cuanto a las recomendaciones de Informe Final respetuosamente indicamos: 2.1. Recomendación # -1 Informe actualizado de los avances y acciones en cumplimento de recomendaciones CNE. - Conforme seguimiento realizado es informa sobre cumplimento de acciones de parte de la Sección Parques y Arboricultura Urbana (correo de Eliecer Alfaro Quesada 22-08-2022 con copias a sus personas) en el tema de control de escorrentía superficial de las aguas de lluvia, quedando pendiente construcción de una pequeña caja de registro para la salida de las aguas al cordón de caño pronta a ejecutar. 2.2. Recomendación # 2- Informe de la determinación de invasión de los retiros a la zona de protección rio Torres. • Oficio DICG-255-2022 concluye que el área de interés corresponde a una zona de protección del rio Torres cuyo propietario es Urbanizadora al Florida S.A., sujeto privado y no este ente municipal. Según imagen de interposición del plano catastrado 51-318375- 1978 sobre digitalización del plano madre SI-6863-1969 no se observa Invasión del área de protección por construcción, esto conforme oficio DICG-286-2022, Con relación a la recomendación de la demolición de la estructura de lavandería, el tema no es resorte de esta oficina.
Ante la consulta realizada a Arq. Melissa Gómez Salas de Permisos de Construcción se indica que al base de datos de permisos de construcción no se registra ninguna solicitud de permiso en la propiedad con número 5J-318375-1987 y en cuanto a la determinación de Invasión se recomienda en cumplimento de la normativa de la Ley Forestal, art.33 consultar sobre particular al INVU, ente que da criterio sobre retiros a los ríos. 2.3. Recomendación # .3 Remitir oficios girados a al Direccione de Agua del MINAE para correspondientes permisos de labores en cauce del rio Torres. Consideramos no procedente esta recomendación. ya que en este momento no existe provecto definitivo de estabilización de laderas del parque municipal, y le mismo queda sujeto a la aprobación de los recursos para contratación de estudios previos y la viabilidad de los resultados. Cabe señal que, a este ente municipal no le corresponde gestionar permisos en propiedades de terceros. 2.4.
Recomendación # 4- Presupuesto con carácter prioritario de los fondos para estudios. • Con respecto a la presupuestación de recursos para los estudios de suelo, diseño y presupuesto de la obra en la propiedad municipal, conforme proceso institucional establecido de liquidación presupuestaria 2022, esta Oficina presentará solicitud de recursos en enero del año 2023 conforme corresponda. 2.5. Recomendación # -5 Realizar una nueva inspección al sitio y llevar a cabo la limpieza del cauce • Con relación a la recomendación de limpieza del cauce, según criterios SCMRP-361-2022 emitido por la Sección de Construcción y Mantenimiento de Red Pluvial no se requiere realizar la misma, ya que las crecidas del río lavarán material acumulado y le mismo no Incide en la estabilidad de ladera. Así las cosas, esta oficina da por cumplido con las recomendaciones emitidas en Informe Técnico CNE-UIAR-INF-0521-2022 en marco de ordenamiento jurídico y ámbito de su competencia”. (Ver prueba documental).
En cuanto la tema de estabilización de laderas del parque municipal y la definición del proyecto, es aclara que no se puede establecer un proyecto sin realizar previamente estudios técnicos. En oficio GPS-OMGRD-178-2022 es indico, que se procederá con la solicitud de recursos en enero del año 2023 para la contratación de estudios de suelo y medidas de mitigación del terreno de propiedad municipal conforme proceso de la liquidación presupuestaria establecido, haciendo la salvedad que al presupuestación de recursos está sujeta a aprobación de la Comisión de presupuesto. Si los recursos quedan aprobados se continuará con tramite de la contratación administrativa del estudio previsto para segundo semestre del año 2023. El alcance del estudio comprende estudio de suelos, diseños y presupuestos de las medidas de estabilización. Una vez conocida esta información Gerencia de Provisión de Servicios valora implementación de obra conforme existencia de recursos financieros, y la modalidad de su ejecución (sea por administración asignado la dependencia ejecutora según medidas de estabilización de ladera recomendadas o contratación). 3.
Con relación a la limpieza del cauce y acumulación del material en el cauce del rio Torres, se mantiene criterio técnico emitido por la Sección de Mantenimiento y Construcción de Red Pluvial de que material acumulado no incide sobre estabilidad de ladera v dada la dinámica fluvial el mismo es susceptible al arrastre y no requiere su retiro. Aclarando a su vez, que procesos de canalización de cauces de dominio público v/o contención o corrección de procesos de erosión natural asociados a la dinámica fluvial de los ríos no es competencia de esta institución. Y que al reducción de riesgo es de un tema de corresponsabilidad en donde corresponde también a sujetos privados conocer amenazas existentes en entorno de su hábitat y tomar acciones de aseguramiento de sus bienes”. (Ver prueba documental).
IV.Sobre el caso en concreto. En el sub iudice, la accionante manifiesta que, en el 2017, debido a un fuerte invierno, iniciaron varios deslizamientos cerca del parque municipal contiguo a su propiedad. Asegura que uno de esos deslizamientos estaba aproximadamente a 50 metros de su propiedad. Por esa situación, se apersonó en la Comisión Nacional de Emergencias y a la Municipalidad de San José, instancias ante las que solicitó que se interviniera ese deslizamiento, pues si continuaba iba a afectar su propiedad. Menciona que en la municipalidad le indicaron que debía reforestar esa zona, situación que realizaron; no obstante, en el 2022, debido a las fuertes lluvias, se volvió a dar el deslizamiento, esta vez cediendo más terreno y provocando un hueco enorme que ya está a escaso 1 metro de llegar a la parte trasera de su casa. Por ende, acudió nuevamente a la Comisión Nacional de Emergencias y a la Municipalidad de San José.
Asegura que de la municipalidad recibió un plástico que no abarca ni una cuarta parte del deslizamiento. Asimismo, la Comisión Nacional de Emergencias recomendó lo siguiente: “a) estabilizar el talud como parte de las responsabilidades de la Municipalidad de San José; b) cortar los árboles y sembrar zacate tipo "vertivery C"; c) hacer unos caños para que las aguas drenen hacia el frente del parque y no hacia el talud”. Añade que no recibió respuesta por parte de la Municipalidad, por lo que tuvo que acudir a la Defensoría de los Habitantes y ante su intervención la municipalidad expresó que no iba a intervenir el talud, por lo que su familia sigue en riesgo ante la posibilidad de un nuevo deslizamiento. Agrega que presenta varios documentos para evidenciar que desde hace más de 5 años la Municipalidad de San José conoce la situación y no ha hecho nada al respecto. Como punto de partida, la Sala recuerda su jurisprudencia en cuanto a competencias municipales y la necesidad de coordinación interinstitucional:
“IV.- COMPETENCIA MUNICIPAL Y OBLIGACIÓN DE COORDINACIÓN INTERINSTITUCIONAL. Competencia municipal y obligación de coordinación interinstitucional. El artículo 169, de la Constitución Política, dispone que "La administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal (...)". Esta norma ha sido desarrollada por el legislador ordinario, en atención a ello, el artículo 3, del Código Municipal, Ley N° 7794 de 30 de abril de 1998, dispone que: "El gobierno y la administración de los intereses y servicios cantonales estarán a cargo del gobierno municipal". En este mismo sentido, se ha expresado la Sala Constitucional en su jurisprudencia. Verbigracia, en Sentencia N° 5445-99, de las 14:30 horas del 14 de julio de 1999, se dispuso lo siguiente:
"VI.- DE LAS ATRIBUCIONES DE LAS MUNICIPALIDADES EN RAZÓN DE LA MATERIA (CONCEPTO DE "LO LOCAL"). Por disposición constitucional expresa -artículo 169-, hay una asignación de funciones o atribuciones en favor de los gobiernos locales en razón de la materia a "lo local", sea, "la administración de los servicios e intereses" de la localidad a la que está circunscrita, para lo cual se la dota de autonomía (") De manera que sus potestades son genéricas, en tanto no hay una enumeración detallada de sus cometidos propios, sino una simple enunciación del ámbito de su competencia; pero no por ello no determinable, a lo que hizo referencia este Tribunal en sentencia número 6469-97, de las dieciséis horas veinte minutos del ocho de octubre de mil novecientos noventa y siete, en los siguientes términos:
"(...) lo local tiene tal connotación que definir sus alcances por el legislador o el juez, debe conducir al mantenimiento de la integridad de los intereses y servicios locales, de manera que ni siquiera podría el legislador dictar normativa que tienda a desmembrar el Municipio (elemento territorial), si no lo hace observando los procedimientos previamente establecidos en la Constitución Política; ni tampoco promulgar aquella que coloque a sus habitantes (población) en claras condiciones de inferioridad con relación al resto del país; ni la que afecte la esencia misma de lo local (gobierno), de manera que se convierta a la Corporación en un simple contenedor vacío del que subsista solo la nominación, pero desactivando todo el régimen tal y como fue concebido por la Asamblea Nacional Constituyente. En otro giro, habrá cometidos que por su naturaleza son municipales -locales- y no pueden ser substraídos de ese ámbito de competencia para convertirlos en servicios o intereses nacionales, porque hacerlo implicaría desarticular a la Municipalidad, o mejor aún, vaciarla de contenido constitucional, y por ello, no es posible de antemano dictar los límites infranqueables de lo local, sino que para desentrañar lo que corresponde o no al gobierno comunal, deberá extraerse del examen que se haga en cada caso concreto (...)". De lo anterior, resalta el hecho de que, por voluntad expresa de nuestra Carta Fundamental, se asigna una competencia específica a los gobiernos locales, atribución que además es exclusiva de éstos; es decir, se trata de una competencia originaria de la municipalidad y sólo mediante una ley de nacionalización o de regionalización es que puede ser desplazada, total o parcialmente".
En consecuencia, si un grupo de munícipes, en su circunscripción territorial, sufren inundaciones con riesgo para sus vidas y graves daños patrimoniales, psicológicos, calidad de vida y bienestar general, esto se enmarca dentro del concepto de "intereses y servicios locales" del numera 169, constitucional, problemas cuyas causas tienen que ser identificadas con precisión y, más aun, las soluciones, a fin de implementarlas a la mayor brevedad posible; para lo cual corresponde a la Municipalidad coordinar con las instituciones de nivel nacional con competencia para actuar sobre el problema. En efecto, la Sala ya ha desarrollado la obligación municipal de coordinar con otras instituciones estatales en aras de atender los "intereses" y prestar cumplidamente los "servicios locales". En la citada Sentencia N° 5445-99, la Sala manifestó:
"(...) se refieren a la obligación de coordinación que debe existir entre los gobiernos locales, las instituciones descentralizadas y el Poder Ejecutivo, para llevar a cabo las funciones que le han sido encomendadas, lo que debe ser analizado a partir de la naturaleza misma de la autonomía municipal. Es en virtud de lo dispuesto en el artículo 170 constitucional, que las municipalidades (entes corporativos locales) gozan de autonomía funcional, administrativa y financiera en la administración de los intereses y servicios locales (artículo 169 de la Constitución Política) (...) No puede, entonces, crearse un conflicto por antagonismo o protagonismo entre la materia que integra el fin general de "los intereses y servicios locales" de los intereses y servicios públicos "nacionales" o "estatales", intrínsecamente distintos unos de otros, pero que en realidad están llamados a coexistir (....) Definida la competencia material de la municipalidad en una circunscripción territorial determinada, queda claro que habrá cometidos que por su naturaleza son exclusivamente municipales, a la par de otros que pueden ser reputados nacionales o estatales; por ello es esencial definir la forma de cooparticipación de atribuciones que resulta inevitable, puesto que la capacidad pública de las municipalidades es local, y la del Estado y los demás entes, nacional; de donde resulta que el territorio municipal es simultáneamente estatal e institucional, en la medida en que lo exijan las circunstancias. Es decir, las municipalidades pueden compartir sus competencias con la Administración Pública en general, relación que debe desenvolverse en los términos como está definida en la ley (artículo 5 del Código Municipal anterior, artículo 7 del nuevo Código), que establece la obligación de "coordinación" entre la municipalidades y las instituciones públicas que concurran en el desempeño de sus competencias, para evitar duplicaciones de esfuerzos y contradicciones, sobre todo, porque sólo la coordinación voluntaria es compatible con la autonomía municipal por ser su expresión. En otros términos, la municipalidad está llamada a entrar en relaciones de cooperación con otros entes públicos, y viceversa, dado el carácter concurrente o coincidente -en muchos casos-, de intereses en torno a un asunto concreto. En la doctrina, la coordinación es definida a partir de la existencia de varios centros independientes de acción, cada uno con cometidos y poderes de decisión propios, y eventualmente discrepantes; pese a ello, debe existir una comunidad de fines por materia, pero por concurrencia, en cuanto sea común el objeto receptor de los resultados finales de la actividad y de los actos de cada uno". De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible "concierto" interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros".
Adviértase, por lo demás, que las Municipalidades están obligadas, por imperativo del ordinal 50, de la Constitución Política, a prodigarse en la protección del ambiente (sentencia n.° 2006-7994 de las 8:57 horas de 2 de junio de 2006)” (sentencia n.° 2020-10630 de las 9:15 horas del 12 de junio de 2020).
Ahora bien, en el sub examine, se tiene por verificado que, en 2017, la accionante planteó una denuncia ante la Municipalidad de San José por deslizamiento de terreno municipal contiguo a su casa de habitación. A tal gestión se le asignó el incidente n.° 2017-09-28-01596. La vivienda que habita la amparada se ubica sobre borde de la ladera correspondiente a margen izquierda del rio Torres y presenta durante los periodos lluvioso desprendimientos de terreno aunados a la problemática de erosión lateral provocada por el rio. El proceso de inestabilidad afecta el terreno colindante al parque municipal, la casa de la señora Nombre78921 y otras propiedades situadas en la margen del rio de la Urbanización Florida Norte y al parque mismo. La problemática de inestabilidad se potenció con la construcción de la carretera hacia Tibás al realizar entubado y desvío del cauce en década de los años 90. El Comité Municipal de Emergencia de San José, mediante informe del 30 de setiembre de 2017, determinó: “•CNE solicitud de valoración de riesgo por inestabilidad de terreno y seguridad de la casa #D-1, área de juegos infantiles, área de cancha y viviendas colindante. •MSJ: Valoración de terreno municipal y de la seguridad humana, medidas de mitigación con relación a la malla perimetral.
Valoración de medidas de estabilización del terreno municipal contigua a la casa # . •Traslado del informe al Area (sic) Rectora de Salud Merced, mbre9687 y y la Uruca- según su marco de competencia. •A la población- vigilancia y monitoreo del comportamiento de deslizamientos”. El 2 de octubre de 2017 se solicitó a la CNE la evaluación visual de riesgo en la Urbanización La Florida Norte tras los derrumbes que se han dado en la margen derecha del río Torres. Mediante informe técnico IAR-INF-1008-2017 de 2017, denominado: “Valoración de riesgo de urbanización Florida Norte por inestabilidad de talud y deslizamiento”. En tal documento se determinó: “V. Conclusiones A. La sobre saturación del terreno causado por las fuertes lluvias junto a la erosión lateral del rio es lo que aparentemente disparó el desprendimiento material. B. La vivienda junto al talud está en riesgo ya que cercanía con el borde podría provocar daños directos de darse nuevos desprendimientos en un futuro.
C. De no realizarse acciones de mitigación en el rio y en la ladera se podrían dar más desprendimientos y afectar directamente las estructuras de las viviendas y el parque en un futuro, especialmente durante eventos meteorológicos extraordinarios. VI. Recomendaciones A. Se debe dar parte a los vecinos colindantes con el talud del riesgo para que estén vigilantes de que se den más desprendimientos y que estén atentos durante eventos meteorológicos extraordinarios para que tomen las medidas preventivas a tiempo; especialmente a la de la señora mbre78921 q que el riesgo es mayor por la cercanía al talud. B. Se debe realizar sistemas de drenaje sobre el talud para garantizar el buen manejo de las aguas pluviales para evitar la saturación de los suelos y disminuir el riesgo de más desprendimientos. C. Se debe valorar la posibilidad de realizar una obra de protección o dragado para colocar rocas en la margen del rio para disminuir los efectos de la erosión lateral.
D. Para realizar unas obras en causes de dominio público, se debe contar con los permisos respectivos del Departamento de Aguas del MINAET y de la Municipalidad correspondiente; por lo que se debe recordar a estas instituciones de la urgencia de estas para facilitar cualquier gestión. A. Las acciones que se realicen deben estar respaldadas por los estudios técnicos correspondientes y ser supervisadas por un profesional de competencia y acreditado”.
Además, la Sala advierte que en 2022 la accionante volvió a denunciar que el problema persistía, por lo que la encargada de la Oficina Municipal de Gestión de Riesgo a Desastres de la Municipalidad de San José solicitó a la CNE realizar la evaluación visual y cualitativa del terreno ubicado en Dirección50, sobre la margen izquierda del rio Torres. Así, mediante informe técnico CNE-UIAR-INF-0521-2022 del 30 de mayo de 2022, la CNE realizó la “Valoración de riesgo de terreno en Dirección4834, por problemas de erosión lateral e inestabilidad de ladera en margen izquierda de río Torres”. En tal documento se determinó: “V. Conclusiones A. Según el Mapa de Amenazas Naturales Potenciales de la CNE, el terreno evaluado donde se ubica el parque Municipal y la vivienda de la señora Nombre78921, se encuentran en la zona de influencia por crecidas repentinas del río Torres, el cual tiene el potencial de generar problemas de anegamientos y erosión lateral sobre las márgenes.
En el terreno de interés los principales problemas son la inestabilidad en las laderas debido al proceso de socavamiento que genera la dinámica del caudal sobre las márgenes y la erosión por inadecuados manejos de aguas de escorrentía superficial. B. El terreno donde se realiza la evaluación se localiza dentro de la microcuenca del rio Torres, colindante con la zona de protección sobre la margen izquierda. Este cauce posee grandes descargas de caudal cuando se presentan lluvias fuertes o extraordinarias en la parte alte, debido a que es un colector principal de aguas pluviales, servidas y de escorrentía de la zona alta del este del San José. C. La propiedad de la señora Nombre78921 posee frente a calle pública, colinda en su lindero norte con la zona de protección y cañón del río Torres, con el parque municipal del este y con otras propiedades en los límites restantes. D. Las infraestructuras presentes en el terreno evaluado estaban retiradas más de 10 metros al borde del cauce, esta distancia se ha reducido en los últimos años como resultado de la acción erosiva y desprendimientos provocados por el caudal del río Torres sobre ambas márgenes, debido a las crecidas extraordinarias que generan problemas localizados.
E. Se observan procesos erosivos y de socavamiento en los taludes de ambas márgenes, sobre la margen izquierda; margen de interés con la que colinda el terreno evaluado, se han generado varios colapsos de terreno reduciendo la distancia del cauce con el límite de la propiedad y aumentado la verticalidad del talud. Además, existen escombros y materiales en el lecho del cauce que desvían constantemente el caudal hacia las márgenes, generando permanentemente erosión e incrementando la inestabilidad del sector, así como la reducción de la capacidad hidráulica de la sección. F. En la zona existe vegetación en el borde del cauce, la cual aumenta la inestabilidad debido a la carga que ejerce sobre el suelo y a la remoción que propician las raíces de gran tamaño. Algunos árboles de gran tamaño han colapsado hacia el cauce por su gran peso y la erosión a la base. G. En el sitio evaluado, propiedad de la señora Nombre78921, se evidenciaron agrietamientos en el suelo que muestren una inestabilidad del sector debido a problemas de deformación por el asentamiento diferencial.
Sin embargo, en la vivienda no se observan grietas o deformaciones que podrían sugerir una mayor área de inestabilidad que comprometa la estructura. La continua erosión y desprendimientos del talud del río Torres podrían generar problemas en la estructura y eventuales colapsos. H. En propiedad aledaña donde se ubica el parque municipal se observa construcción de un muro paralelo al talud muy cercano al borde y dentro de la zona de protección del río Torres. Esta obra desvía las aguas de escorrentía superficial; caídas durante lluvias intensa, hacia la colindancia con la vivienda de la señora Nombre78921, aumentando las condiciones de inestabilidad y alta susceptibilidad a desprendimientos en todo el sector. VI. Recomendaciones. A. Se recomienda en el terreno propiedad de la señora Nombre78921 y el colindante donde está el parque Municipal, un sistema adecuado para el control, la recolección y el drenaje de aguas pluviales y escorrentía superficial, para que estas no sean descargadas hacia el talud con problemas de estabilidad y la margen del cauce, generando erosión y de desprendimientos constantes, B. Se debe respetar la distancia del retiro al cauce del rio Torres, la cual está definida como la zona de protección, establecida según el artículo N° 33 de la Ley Forestal 7575, donde no se permiten construcciones o infraestructuras.
C. Se recomienda a la Municipalidad de San José NO brindar permisos de construcción en las áreas de protección de ríos, quebradas y acequias que drenan el cantón; así como en áreas de relleno, fuertes pendientes o vulnerables a las amenazas naturales. D. La señora Nombre78921, Municipalidad de San José y todos aquellos vecinos colindantes con el cauce del río Torres en la sección evaluada, deberán buscar la evaluación parte de un ingeniero forestal de los árboles que se ubican en el borde el cauce, para establecer la posibilidad de derramar o eliminar lo más pronto posible estos con el fin de quitar peso debido a su ubicación en el sector, los cuales aumentan la inestabilidad del suelo en el sitio, previo a la solicitud de corta y coordinación ante la Dirección de Aguas del MINAE. E. La Municipalidad de San José deberá facilitar a la señora Nombre78921 plástico resistente para que sea colocado en el talud del río Torres; el cual presenta agrietamientos y potencial de nuevos colapsos, con el fin de evitar la constante infiltración de aguas pluviales que dispare nuevas caídas de material.
F. Habiendo quitado peso al talud con la remoción de la vegetación que aumenta la inestabilidad, la señora Nombre78921 en coordinación con la Municipalidad de San José y todos aquellos vecinos colindantes con el cauce del río Torres, deberán colocar vegetación de poca altura que aumenta la inestabilidad, la señora Nombre78921 en coordinación con la Municipalidad de San José y todos aquellos vecinos colindantes con el cauce del río Torres, deberán colocar vegetación de poca altura y peso con gran desarrollo de sistema radial (tipo vetiver), que ayuda a la preservación del suelo y mantenga la estabilidad en el talud, disminuyendo la erosión y desprendimientos de material. G. La Municipalidad de San José en coordinación con los vecinos afectados en el sitio evaluado, deberán solicitar ante la Dirección de Aguas de MINAET el permiso para realizar obras de estabilización del talud en el cauce y zona de protección del rio Torres, las cuales permitan dar soporte y estabilidad a los taludes que se encuentran actualmente inestables y propensos a deslizamientos.
I. Las obras constructivas o de estabilización que se implementen en la zona evaluada deben ser supervisadas por un profesional agremiado al Colegio Federado de Ingenieros y Arquitectos de Costa Rica, con base en las normas establecidas por el Código Sísmico, Código de Cimentaciones y Reglamento de Construcciones, Código Municipal y otra legislación vigente. J. Cualquier anomalía en cuanto a técnicas de construcción u omisión a las recomendaciones aquí descritas, QUEDA BAJO TOTAL RESPONSABILIDAD de las instituciones que otorgan los permisos, del ingeniero o responsable de la obra y de la Municipalidad respectiva de no solicitar los informes, inspecciones y correcciones correspondientes”.
Por su parte, precisamente debido a que los accionados no solventaron el problema objeto de este recurso, es que, el 27 de junio de 2022, la recurrente planteó una denuncia ante la Defensoría de los Habitantes, en la que solicitó su intervención para que la Municipalidad de San José cumpliera con los trabajos recomendados por la Comisión Nacional de Emergencias. Mediante oficio n.° 06696-2022-DHR del 6 de julio de 2022, la Defensoría de los Habitantes dio traslado de la gestión de la amparada y solicitó informe a la Municipalidad de San José. La Defensoría de los Habitantes, mediante oficio n.° 07906-2022-DHR del 10 de agosto de 2022 rindió el informe final y recomendó: “1. Remitir un informe actualizado de los avances y acciones ejecutadas a fin de cumplir con las recomendaciones giradas por la CNE en el informe técnico N° CNE-UIAR-0521-2022 de fecha 30 de mayo del 2022. 2. Remitir el informe producto de la inspección realizada a fin de determinar si existe invasión de los retiros a la zona de protección del rio Torres y de las acciones que se ejecutarán al respecto en caso de encontrarse irregularidades. 3.
Remitir los oficios girados por dicho gobierno municipal solicitando a la Dirección de Aguas del MINAE los correspondientes permisos para labores que deben llevarse a cabo en el cauce del rio Torres. 4. Presupuestar, con carácter prioritario, los fondos para el estudio de suelo, diseño y presupuesto de las labores a realizarse en el cauce del río Torres. 5. Realizar una nueva inspección al sitio y llevar a cabo la limpieza del cauce, a fin de que los escombros y materiales que se encuentren en el mismo (a pesar de ser pocos), no generen más inestabilidad en las riberas del río”. La encargada de la Oficina Municipal Gestión de Riesgo a Desastres de la Municipalidad de San José, por oficio GPS-OMGRD-178-2022 del 22 de agosto de 2022, señaló: “En atención a los oficios DAJ-1960-2022, DAJ-1961-2022 y ALCALDIA-02016-2022 con relación al Informe Final de Recomendaciones de la Defensoría de los Habitantes sobre denuncia presentada por la señora Nombre78921 por inestabilidad de ladera del río Torres me permito a comunicar lo siguiente: 1.
Ante la amenaza de erosión y socavamiento de la ladera del río Torres en su margen izquierda y al condición de vulnerabilidad de la infraestructura pública (parque municipal) y propiedad privada (casa de la señora Nombre78921, plano catastro SJ-318375-1978) en seguimiento la Informe Técnico CNE-UIAR-INF-0521-2022 esta Oficina estableció un plan de acción para cumplimento de las recomendaciones emitidas por CNE. Las actividades del plan es suscriben solamente la terreno propiedad municipal, y no contemplan la intervención en terreno privado dada la competencia institucional y alcance de intención en zonas de protección de los cuerpos de agua y/o propiedades privadas. 2. En cuanto a las recomendaciones de Informe Final respetuosamente indicamos: 2.1. Recomendación # -1 Informe actualizado de los avances y acciones en cumplimento de recomendaciones CNE. - Conforme seguimiento realizado es informa sobre cumplimento de acciones de parte de la Sección Parques y Arboricultura Urbana (correo de Eliecer Alfaro Quesada 22-08-2022 con copias a sus personas) en el tema de control de escorrentía superficial de las aguas de lluvia, quedando pendiente construcción de una pequeña caja de registro para la salida de las aguas al cordón de caño pronta a ejecutar. 2.2.
Recomendación # 2- Informe de la determinación de invasión de los retiros a la zona de protección rio Torres. • Oficio DICG-255-2022 concluye que el área de interés corresponde a una zona de protección del rio Torres cuyo propietario es Urbanizadora al Florida S.A., sujeto privado y no este ente municipal. Según imagen de interposición del plano catastrado 51-318375- 1978 sobre digitalización del plano madre SI-6863-1969 no se observa Invasión del área de protección por construcción, esto conforme oficio DICG-286-2022, Con relación a la recomendación de la demolición de la estructura de lavandería, el tema no es resorte de esta oficina. Ante la consulta realizada a Arq. Melissa Gómez Salas de Permisos de Construcción se indica que al base de datos de permisos de construcción no se registra ninguna solicitud de permiso en la propiedad con número 5J-318375-1987 y en cuanto a la determinación de Invasión se recomienda en cumplimento de la normativa de la Ley Forestal, art.33 consultar sobre particular al INVU, ente que da criterio sobre retiros a los ríos. 2.3.
Recomendación # .3 Remitir oficios girados a al Direccione de Agua del MINAE para correspondientes permisos de labores en cauce del rio Torres. Consideramos no procedente esta recomendación. ya que en este momento no existe provecto definitivo de estabilización de laderas del parque municipal, y le mismo queda sujeto a la aprobación de los recursos para contratación de estudios previos y la viabilidad de los resultados. Cabe señal que, a este ente municipal no le corresponde gestionar permisos en propiedades de terceros. 2.4. Recomendación # 4- Presupuesto con carácter prioritario de los fondos para estudios. • Con respecto a la presupuestación de recursos para los estudios de suelo, diseño y presupuesto de la obra en la propiedad municipal, conforme proceso institucional establecido de liquidación presupuestaria 2022, esta Oficina presentará solicitud de recursos en enero del año 2023 conforme corresponda. 2.5.
Recomendación # -5 Realizar una nueva inspección al sitio y llevar a cabo la limpieza del cauce • Con relación a la recomendación de limpieza del cauce, según criterios SCMRP-361-2022 emitido por la Sección de Construcción y Mantenimiento de Red Pluvial no se requiere realizar la misma, ya que las crecidas del río lavarán material acumulado y le mismo no Incide en la estabilidad de ladera. Así las cosas, esta oficina da por cumplido con las recomendaciones emitidas en Informe Técnico CNE-UIAR-INF-0521-2022 en marco de ordenamiento jurídico y ámbito de su competencia”. La encargada de Oficina Municipal de Gestión de Riesgo a Desastres y el gerente de Provisión de Servicios, ambos de la municipalidad de San José, por oficio GPS-OMGRD-198-2022 del 8 de setiembre de 2022, señaló: “En atención a sus oficios DAJ-2178-30-2022 yDAJ-2180-30-2022, relacionado con Informe Final de Recomendaciones emitido por Defensoría de los Habitantes sobre caso presentado por la señora Nombre78921 por inestabilidad de ladera del río Torres y solicitud de información adicional manifestamos lo siguiente: 1 La construcción de una caja de registro está a cargo de la Sección de Parques y Arboricultura Urbana y se ha instruido a la sección sobre particular.
Según consulta realizada a los responsables de esta acción ingenieros Raúl Acosta Solorzano y Eliecer Alfaro Quesada se tiene planeado a terminar trabajo pendiente (relleno, enzacatado y construcción de la caja registro) en el periodo comprendido entre 19 y 30 de setiembre 2022. 2. En cuanto la tema de estabilización de laderas del parque municipal y la definición del proyecto, es aclara que no se puede establecer un proyecto sin realizar previamente estudios técnicos. En oficio GPS-OMGRD-178-2022 es indico, que se procederá con la solicitud de recursos en enero del año 2023 para la contratación de estudios de suelo y medidas de mitigación del terreno de propiedad municipal conforme proceso de la liquidación presupuestaria establecido, haciendo la salvedad que al presupuestación de recursos está sujeta a aprobación de la Comisión de presupuesto. Si los recursos quedan aprobados se continuará con tramite de la contratación administrativa del estudio previsto para segundo semestre del año 2023.
El alcance del estudio comprende estudio de suelos, diseños y presupuestos de las medidas de estabilización. Una vez conocida esta información Gerencia de Provisión de Servicios valora implementación de obra conforme existencia de recursos financieros, y la modalidad de su ejecución (sea por administración asignado la dependencia ejecutora según medidas de estabilización de ladera recomendadas o contratación). 3. Con relación a la limpieza del cauce y acumulación del material en el cauce del rio Torres, se mantiene criterio técnico emitido por la Sección de Mantenimiento y Construcción de Red Pluvial de que material acumulado no incide sobre estabilidad de ladera v dada la dinámica fluvial el mismo es susceptible al arrastre y no requiere su retiro. Aclarando a su vez, que procesos de canalización de cauces de dominio público v/o contención o corrección de procesos de erosión natural asociados a la dinámica fluvial de los ríos no es competencia de esta institución.
Y que al reducción de riesgo es de un tema de corresponsabilidad en donde corresponde también a sujetos privados conocer amenazas existentes en entorno de su hábitat y tomar acciones de aseguramiento de sus bienes”. La Defensoría de los Habitantes, por oficio 09838-2022-DHR del 1° de octubre de 2022 solicitó a la Municipalidad de San José aclarar: “En razón de lo anterior se le solicita que aclare detalladamente los siguientes puntos y remita los documentos que a continuación se indican: 1. En el mencionado oficio se indica que la caja de registro faltante se terminaría de construir entre el 19 y el 30 de setiembre del presente año. ¿Ya se concluyó con dicha obra? 2. En caso de que su respuesta sea negativa, favor indicar las razones del retraso e indicar cuándo se proyecta haber concluido con la misma. 3. ¿Cada cuánto tiempo se da mantenimiento a los árboles y vegetación del parque? Favor remitir el programa de mantenimiento del mismo”.
La jefa a. i. de la sección de Parques y Arboricultura Urbana de la Municipalidad de San José, por oficio SPAU-587-2022 del 5 de octubre de 2022 manifestó: “Con referencia a la solicitud de valoración de caso expuesto en el oficio DAJ-2444-30-2022, Expediente 256536, le informo sobre los puntos consultados, competencia de la Sección de Parques: 1. Informar sobre conclusión de construcción de la caja de registro programada entre 19 y 30 de setiembre. Se informa que al caja ya está construida y solamente hace falta colocar al rejilla, labor que está programada realizar el día 12 de octubre del año en curso por parte del Ing. Eliécer Alfaro Quesada. 2. Aportar cronograma de mantenimiento de árboles y vegetación del parque. El área del parque, como todas las áreas que atiende al sección, en las zonas periféricas del cantón, tiene una frecuencia de atención mensual, en donde se realiza la limpieza y mantenimiento de las zonas verdes, y se realizan podas menores que requieran mantenimiento preventivo, y en el caso que existan podas de mayor complejidad es trasladan al Ing. Randall Ramírez para la programación en ruta de este tipo de intervenciones, sin embargo es él ha dado al instrucción que es realicen visitas periódicas en el sector para ver estado del arbolado y al necesidad de intervenciones de este tipo”.
La Defensoría de los Habitantes, por oficio 12287-2022-DHR del 2 de diciembre de 2022, solicitó a la Municipalidad de San José aclarar lo siguiente: “1. En el mencionado oficio se indica que la caja de registro faltante ya estaba concluida y que solo le faltaba la rejilla, la cual se colocaría el 12 de octubre. ¿Ya colocó dicha rejilla? 2. En conversación mantenida por teléfono con la denunciante, señala que la caja de registro no funciona correctamente y que el agua se estanca. Favor realizar una inspección a fin de determinar el funcionamiento de la misma e informar a la Defensoría al respecto. 3. ¿Cada cuánto tiempo se da mantenimiento a los árboles y vegetación del parque? Favor remitir el programa de mantenimiento del mismo más allá de setiembre del presente año, que fue la última fecha reportada a la Defensoría”. El profesional del Área Forestal y el encargado del Proceso de Obra Civil de la Municipalidad de San José, por oficio SPAU-0754-2022 del 9 de diciembre de 2022, indicaron: “1 La rejilla está colocada correctamente (figura 1.) 2.
La base que tiene la caja de registro soporta cierta cantidad de agua y los sedimentos que arrastra la lluvia para ser recolectados después y la verificación de su funcionalidad se verificará en el próximo invierno. 3. Mantenimiento de las áreas verdes del parque: se ejecuta una vez al mes. Poda de árboles: Mantenimiento de los árboles se realiza una vez al año (mes de julio), cabe anotar que el día 08 y 9de diciembre del año en curso se programaron labores de Poda del parque en cuestión de los árboles : Llama del Bosque, Sota Caballo, Dama, Aguacate y Moringa, lo anterior es realizo con la finalidad de liberar el alumbrado público y el tendido eléctrico y levantar copas de estas especies”.
A partir de estos elementos, la Sala tiene certeza suficiente para estimar que el problema denunciado existe, es conocido por las autoridades recurridas y no ha sido solucionado en aproximadamente seis años.
Así, recuérdese que este Tribunal tiene el deber de resguardar la vida e integridad física de las personas y, dado el caso, conminar a las instancias estatales para que velen por tales derechos. En el caso de marras, la Sala estima innegable que la omisión de la parte accionada afectó los derechos de la recurrente y demás vecinos afectados por el talud, dado que se toleró que su vida e integridad física corrieran riesgo innecesariamente, a pesar de las advertencias que se dan desde hace años. En virtud de lo expuesto se declara con lugar el recurso, con las consecuencias indicadas en la parte dispositiva de esta sentencia.
V.Nota del magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.
A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
VI.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Johnny Araya Monge y Lorena Romero Vargas, por su orden, alcalde y encargada de la Oficina de Gestión de Riesgo a Desastres, ambos de la Municipalidad de San José; así como a Alejandro José Eduarte, en su condición de presidente de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, o a quienes ejerzan esos cargos, lo siguiente: 1.- coordinar lo necesario a efectos de valorar la necesidad y, dado el caso, implementar una medida cautelar a fin de garantizar la vida e integridad física de las personas afectadas por el talud objeto de este proceso, en el plazo de CINCO DÍAS HÁBILES, contado a partir de la notificación de esta sentencia; 2- integrar una comisión para valorar el caso y determinar una solución definitiva, técnica y jurídicamente adecuada. En el cumplimiento de este punto deberá establecerse un cronograma para la implementación de la solución mencionada.
Todo lo anterior deberá efectuarse en el plazo de UN MES, contado a partir de la notificación de esta sentencia; 3- cumplir el cronograma señalado en el punto anterior. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San José y a la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Castillo Víquez consigna nota. Notifíquese.
