Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine fifteen a.m. on January 13, 2023.
Amparo proceeding (recurso de amparo) filed by Nombre112652, identity card No. CED44362, and Nombre81214, identity card No. CED44363, against the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.
Findings:
Justice Araya García delivers the opinion; and,
Considering:
I.Subject matter of the proceeding. The petitioners allege that they own the property registered in the Province of Alajuela, Canton of San Carlos, under folio No. 270766, located in Juanilama de Pocosol, with an area of 59.089,29 m2, according to survey plan A-0007576-1991. They explain that they acquired the property as part of a land-parceling program for various families carried out by the Instituto de Desarrollo Rural and that, from the time of conveyance, the respective boundaries between the properties were clearly marked, which was recorded in the Registro Público. They complain that, notwithstanding the foregoing, SINAC is currently carrying out a “boundary-restaking and fencing” process even though there is no administrative case file to that effect and no notice-of-charges decision has been issued concerning the demarcation of the land. They are therefore being subjected to an expropriation without being afforded due process or the right to a defense (derecho de defensa) regarding this act. They consider their fundamental rights to have been violated. They ask the Chamber to order the respondents to refrain from carrying out boundary-restaking activities on the property.
III.Regarding the specific case. In the case at bar (sub lite), the petitioners allege that they own the property registered in the Alajuela registry district, Cantón de San Carlos, under folio No. 270766, located in Juanilama de Pocosol, with an area of 59.089,29 m2, according to survey A-0007576-1991. They explain that they acquired the property as part of a land-parceling program for various families conducted by the Instituto de Desarrollo Rural and that, from the time of conveyance, the respective boundaries between the properties were clearly marked, which was recorded in the Registro Público. They complain that, despite this, SINAC is currently carrying out a “boundary reestablishment and fencing” process, even though there is no administrative case file (expediente administrativo) to that effect and no statement-of-charges order (resolución de traslado de cargos) has been issued concerning the demarcation of the land, as a result of which they are being subjected to an expropriation without being afforded due process (debido proceso) or the right of defense (derecho de defensa) against this action. They consider their fundamental rights to have been violated.
However, based on the reports submitted under oath by the respondent authorities, this Chamber finds that no violation of the protected parties’ fundamental rights occurred.
This is because it was established that, although the boundary reestablishment and demarcation of a strip of the property that the petitioners claim to own is being carried out, the fact remains that, first, this strip is part of the State Natural Heritage and was ordered transferred to the State-MINAE and, second, the demarcation of the land established that the petitioners have been improperly using an area of 5480 m2 belonging to a State National Heritage property, according to official report SINAC-ACAHN-OTAT-044-2022. Likewise, contrary to the petitioners’ assertions, it was confirmed that they are aware of the situation, because they have been informed that boundary reestablishment work is being carried out on various properties and of the reasons why this is being done, as well as that they have been using an area that does not belong to their property.
Finally, a review of the petition initiating the proceeding established that the petitioners’ principal claim in filing the amparo proceeding (recurso de amparo) is that the boundary reestablishment activities being carried out be suspended and that they thereby be allowed to continue using a portion of land that does not belong to them and forms part of the State Natural Heritage. In this regard, they must be advised that such a claim falls outside the jurisdiction of this Chamber, since legal remedies have been established for determining whether recognition of a property right (derecho de propiedad) over that land is warranted and how it should be demarcated. Consequently, if it deems it appropriate, the petitioning party may raise its objection or claim before the same respondent authorities or before the competent ordinary courts, where it may fully argue the merits of the matter and assert its claims. Accordingly, this petition must be dismissed, as is hereby ordered.
IV.Documentation submitted in the case file. The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computing, magnetic, optical, or telematic device or produced using new technologies, such materials must be collected from the court office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within this period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del trece de enero de dos mil veintitres .
Recurso de amparo interposto por Nombre112652, cédula de identidad No. CED44362 y Nombre81214, cédula de identidad No. CED44363, contra el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Objeto del recurso. Alegan los recurrentes que son propietarios de la finca inscrita al partido de Alajuela, Cantón de San Carlos, a folio No. 270766, ubicada en Juanilama de Pocosol, con una extensión de 59.089,29 m2, según el plano A-0007576-1991. Detallan que adquirieron la propiedad como parte de un programa de parcelación a diversas familias por parte del Instituto de Desarrollo Rural y desde el otorgamiento se señalaron muy bien los límites respectivos entre las propiedades, lo cual quedó inscrito en el Registro Público. Reclaman que, pese a esto, el SINAC en este momento se encuentra realizando un proceso de “replanteo y cercado”, lo anterior, a pesar de que no existe un expediente administrativo en ese sentido ni ha sido emitida resolución alguna de traslado de cargos respecto a la delimitación del terreno, con lo que están siendo víctimas de una expropiación, sin que se les brinde el debido proceso ni el derecho de defensa sobre este acto. Estiman lesionados sus derechos fundamentales. Solicitan a la Sala que se ordene a los recurridos que se abstengan de realizar los actos de replanteo de la propiedad.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
III.Sobre el caso concreto. En el sub lite, los recurrentes acusan que son propietarios de la finca inscrita al partido de Alajuela, Cantón de San Carlos, a folio No. 270766, ubicada en Juanilama de Pocosol, con una extensión de 59.089,29 m2, según el plano A-0007576-1991. Detallan que adquirieron la propiedad como parte de un programa de parcelación a diversas familias por parte del Instituto de Desarrollo Rural y desde el otorgamiento se señalaron muy bien los límites respectivos entre las propiedades, lo cual quedó inscrito en el Registro Público. Reclaman que, pese a esto, el SINAC en este momento se encuentra realizando un proceso de “replanteo y cercado”, lo anterior, a pesar de que no existe un expediente administrativo en ese sentido ni ha sido emitida resolución alguna de traslado de cargos respecto a la delimitación del terreno, con lo que están siendo víctimas de una expropiación, sin que se les brinde el debido proceso ni el derecho de defensa sobre este acto. Estiman lesionados sus derechos fundamentales.
Ahora bien, de los informes rendidos bajo juramento por parte de las autoridades recurridas, esta Sala descarta que se haya producido una lesión a los derechos fundamentales de los amparados.
Lo anterior, por cuanto, se tuvo por acreditado que si bien se está realizando un replanteo y delimitación de una franja de la propiedad de la cual los recurrentes afirman ser propietarios, lo cierto es que, en primer lugar, dicha franja corresponde a un Patrimonio Natural del Estado, la cual se ordenó traspasar al Estado-MINAE y en segundo lugar, de la delimitación del terreno, logró comprobarse que los recurrentes han estado haciendo uso indebido de un área de 5480 m2 que corresponde a finca Patrimonio Nacional del Estado, según informe oficio SINAC-ACAHN-OTAT-044-2022. Asimismo, contrario al dicho de los recurrentes, se pudo constatar que estos tienen conocimiento de la situación, por cuanto, se les ha informado que se están realizando replanteos en diversas fincas y las razones por las cuales esto se está haciendo, así como que han estado utilizando un área que no corresponde a su propiedad.
Finalmente, de la lectura del escrito de interposición, se pudo verificar que la pretensión principal de la parte recurrente al interponer el amparo es que se suspendan los actos de replanteo que se están realizando, y que con esto se les mantenga en uso de un extremo del terreno que no les pertenece y que forma parte del Patrimonio Natural del Estado. Al respecto, debe indicárseles que tal pretensión es ajena al ámbito de competencia de esta Sala, pues para tales efectos se han previsto los medios legales para analizar la procedencia del reconocimiento del derecho de propiedad sobre ese terreno y la forma en que este debe ser delimitado. En consecuencia, de considerarlo pertinente, la parte recurrente puede plantear su inconformidad o reclamo ante las mismas autoridades recurridas o en la jurisdicción ordinaria competente, vías en las que podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. Así las cosas, el presente recurso debe ser declarado sin lugar, como en efecto se dispone.
IV.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara sin lugar el recurso. Notifíquese al Ministerio Público para lo que corresponda.- Fernando Castillo V.
