Document Review Decision No. 2022028682 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty a.m. on dos de diciembre de dos mil veintidos.

Application for constitutional relief (recurso de amparo) filed by Nombre01, identity card number CED01, against the Municipalidad de Pococí and the Ministerio de Salud.

BACKGROUND:

  1. 1In a brief added to this case file on 3 de octubre del 2022, the applicant alleged, in summary, that since abril de 2019, pursuant to a purchase and sale option agreement signed by her son and ultimately formalized on 28 de abril de 2021, she has resided in a dwelling located in La Colonia de Pococí, Guápiles, which forms part of the property designated as DERECHO CERO CERO DOS, acquired by her son and equivalent to a seven-eighths interest in the property registered in the Province of Limón under registration number , with an area of four thousand three hundred fifteen square meters and thirty square decimeters. She states that because she had occupied the property as its owner since abril de 2019, she undertook to clean the entire area corresponding to the aforementioned interest, as it was covered with dense vegetation, waste, glass, shoes, bottles, and solid waste of every kind, including the agricultural easement (servidumbre agrícola) providing access to the property, which at that time also contained a great deal of waste.She recounts that when the rains began, as is characteristic of the area, she observed that the property receives municipal drainage discharged through the adjoining property, consisting not only of stormwater (aguas pluviales), but also of visibly contaminated, foul-smelling wastewater and sewage (aguas servidas y negras) carrying all kinds of solid waste, including diapers, condoms, masks, glass, boots, among other items. She explains that this situation has turned part of the property into waterlogged land without access to a public road, with the resulting implications for human health, risks to physical safety, and proliferation of insects. She states that the property registered under number is not encumbered by a municipal drainage easement (servidumbre municipal de aguas). She reports that the adjoining property to the south voluntarily signed, many years ago, a provisional permit allowing the municipality to divert its water through that property while the road was being paved, because its gravel surface was being washed away.She describes how the population was small at that time and the overflow and flooding problems seen today did not occur. She adds that the original property whose owner signed the permit was subsequently subdivided among family members, each of whom built a house, for which the Municipality granted the relevant construction permits, with the result that the houses were built over the drainage route that discharges all of its water onto her family’s property, on the justification that these are public channels, and all of the community’s pollution ultimately ends up in the yard of her home. Consequently, she states that her house and land flood due to overflowing water whenever it rains, causing economic loss because the land has been eroded and degraded, making it impossible to cultivate, as well as harm to health and physical safety. She asserts that she has lived on the property for three years and has repeatedly raised the problem with the Municipality, including through the Ministerio de Salud, but has obtained no results, even though whenever it rains the water overflows, releasing contaminated water that affects her family’s health and safety, since stagnant water and hazardous waste remain after the rain.She explains that on 20 de agosto 2020, she reported the construction and water problems by email but received no response; on 28 de agosto, she wrote to the municipality through social-media platforms to inform it of the overflowing water and to request information about a formal or legal channel through which to file the appropriate complaints, because COVID 19 prevented her from appearing in person. She states that other virtual channels had been authorized as lawful means of communicating with institutions under emergency measures and that she was referred to a WhatsApp number. She adds that, during the first quarter of 2021, personnel from the Environmental Management Department visited her family’s property for the first time, conducted an inspection, and verbally informed her that the Civil Works Department would provide a solution and that officials from that department would visit her soon; however, nothing has happened.She recounts that on 28 de agosto 2021, as a result of a submission to the Ministerio de Salud, the matter was referred to the municipality, and that since 24 de agosto del 2020 she has communicated with the municipality through WhatsApp in compliance with the measures imposed by the Ministerio de Salud, has sent photographs and videos, and has received no response to her request for a solution to the problem. She states that on 10 de mayo she received a second visit from the Environmental Management Department of the Municipalidad de Pococí and was told that it would seek the best possible solution. Subsequently, on 23 de mayo de 2022, she submitted a written request to the municipality asking it to solve the problem, and the only response she received was that it would meet with CONAVI to seek a solution, but nothing has happened. She argues that the property is not subject to any easement in favor of the Municipalidad de Pococí, an entity that has never constructed any infrastructure to channel that water, forcing her and her children to “swim” amid glass, garbage, and pollution that endanger their health.She alleges that the children must “navigate” the obstacles to attend school and conduct other errands because of the accumulated water. She further claims that agriculture is severely affected because the crops deteriorate due to the contamination, while domestic animals become sick and die after drinking the dirty, foul-smelling water. She requests that the Municipalidad de Pococí be ordered to remove all water and waste from the property, since the community now has paved roads with drainage systems and ditches. She also requests compensation for the material damage caused and, alternatively, if the water cannot be completely removed and the only possible route is through her represented party’s property, that the Municipalidad de Pococí be ordered to conduct a topographic and environmental impact study (estudio topográfico y de impacto ambiental) and obtain the corresponding permits issued by the Secretaría Técnica Nacional Ambiental and the Ministerio de Salud regarding the feasibility of the project; that she be provided information from the municipality’s engineering office concerning the design and construction of the drainage system; and that economic or material compensation be awarded for the damage.
  2. 2By decision issued at 10:39 hours on 5 de octubre del 2022, the applicant was directed to sign the initial filing or ratify its contents.
  3. 3In a brief added to this case file on 6 de octubre del 2022, the applicant ratified the allegations made in the initial filing.
  4. 4By decision issued at 15:05 hours on 6 de octubre del 2022, the proceeding was admitted, and the Municipalidad de Pococí was notified thereof on 13 de octubre del 2022.
  5. 5In a brief added to this case file on 18 de octubre del 2022, Manuel Hernández Rivera, Municipal Mayor, and Jazlyn Morales Grajal, President of the Municipal Council, both of the Municipalidad de Pococí, submitted their report. They stated as follows:

“REPORT:

The facts alleged by the applicant concern REAL PROPERTY RECORD 7 118.583-002, Dirección01, SURVEY PLAN: L-1054201-2006. According to information issued by the Registro Nacional, the nature of this property is: PASTURELAND. The land was acquired by purchase on 22 de mayo 2021 and is bounded to the NORTH by Nombre02; to the SOUTH by an AGRICULTURAL EASEMENT (7m wide), with Nombre03 beyond it; to the EAST by lot 9; and to the WEST by lot 7 and a RIGHT-OF-WAY EASEMENT (SERVIDUMBRE DE PASO) with a frontage 5m wide.

According to information issued by the Construction Control Department, NO CONSTRUCTION PERMIT has been processed for that property. This means that there is NO RESIDENTIAL DWELLING on the property or, alternatively, that the applicant constructed one without obtaining a construction permit, which likely means that the minimum 15m setback required for construction was not observed with respect to the river that crosses her property. Incidentally, it should be noted that this is one of the principal rivers that frequently cause flooding in our canton, especially in low-lying areas such as the communities of La Colonia, Balastre, La Teresa, Ticaban, and other sectors. Moreover, we must remember that rivers themselves reclaim their channels. This river is shown on the registered survey plan attached.

As may be observed, this property was acquired in mayo of last year, does not front onto a public road, and another highly relevant circumstance is that the water flows toward the river crossing the land because of the property’s topography. This natural depression is classified as such in the official letter issued by the Dirección de Aguas, namely Official Letter DA-UHCAROG-0857-2019 (concerning the processing of a neighbor’s survey-plan approval).

As stated in the MAYO DE 2021 FIELD INSPECTION REPORT issued by Engineer Fabián Delgado, the woman indicated that she herself had blocked the culvert passage because her land is not encumbered by any drainage easement, a circumstance that causes flooding on her property.

Official Letter UTGAM-0282-2021 of 24 de mayo de 2021 from the Municipal Environmental Management Office states as follows:

“… During the inspection, water apparently resulting from runoff (escorrentía) was found to be ponding on the property of Mr. Nombre04 because Ms. Nombre01 filled in the purported drainage passage. It is not readily apparent that this is wastewater. ...” There is no doubt that this is a dispute between neighbors of a private nature. Because this land does not front onto a public road, but instead has access by means of a RIGHT-OF-WAY EASEMENT to the south, which leads to Dirección02, and because that road is duly paved (by CONAVI) and has the corresponding ditches and drainage system, this is an agricultural parcel crossed by the San Rafael River, as may be seen on the registered survey plan attached to the report of the municipal engineer from the Construction Control Division.

Accordingly, this is unquestionably a case in which the adjoining property owners must conduct a TOPOGRAPHIC STUDY to IDENTIFY the discharge point, DETERMINE where the STORMWATER originates, and carry out a tacheometric survey (levantamiento taquimétrico). That information will make it possible to determine the design of the pipes or drainage system, depending on the findings of the technical topographic report.

Regarding the relief sought by the applicants:

First: They request that we be ordered to remove all water and waste from their property.

This would entail carrying out public works on private land, which would have serious negative consequences because, as is well known, public resources cannot be invested in that manner.

Second: That we be ordered to repair the material damage caused.

She states that her residential dwelling and land flood; however, the dwelling has no construction permit whatsoever. Furthermore, her property is pastureland and does not adjoin any public road. Moreover, the existing dispute concerns her adjoining property owner because her property receives stormwater that flows toward the San Rafael River, which crosses her property.

Third: Another of her claims (pretensiones) is that, if the waters cannot be completely eliminated and her property is the only route, a topographic survey (estudio topográfico) and environmental impact study (estudio de impacto ambiental) be ordered; that she be informed of the design and construction of the drainage system (alcantarillado); and that the corresponding financial compensation (resarcimiento económico) be provided. Once again, she seeks to have this local government invest public funds in her property, since this representation considers that each interested party should hire the professional services of a surveyor to conduct the corresponding study so that the stormwater (aguas pluviales) on her property may be properly channeled.”

  1. 6In a written submission added to this case file on 26 de octubre del 2022, the appellant (recurrente) stated the following:

“With due respect, I state: I set forth my grievances (agravios) regarding the response contained in the report submitted by the Municipalidad de Pococí, following the order in which it presents its response. This submission is supplemented by a separate filing, and an appendix containing images is provided as counterevidence (contraprueba) to the assertions made in that institution’s report.

A—Honorable Justices, the Municipalidad’s account merely seeks to obscure the actual, ongoing circumstances by diverting attention toward the construction permits. I must state that there IS A RESIDENCE on the property, which has been there for more than 30 years. This residence existed before the physical division of property 7-00017078 (parent property), which was divided and gave rise to property 7-000 118583. It was the only house on the parent property, and when the property was divided into lots, this lot retained the already-constructed residence, to which the previous owner made improvements. As stated, the lot already had the residence when it was acquired; therefore, no construction permit should have been sought.

B—Once again, Honorable Justices, one can see the institution’s lack of interest in this matter when it states that the 15-meter construction setback (retiro) has “probably” not been observed, thereby including an assumption in an official document. I must state that the house is more than 25 from Rio San Rafael at its nearest point and more than 45 meters at its farthest point, thus observing the setback; and, thank God, that river has never overflowed onto this portion of the land. Furthermore, it is true that the property does not adjoin a public street; rather, the waters are conveyed through the drainage system to the neighboring property to the south and discharged onto property 7-000 118583. They are not conveyed to the RIO, nor do they flow toward the river, but instead toward other lots and the residential settlement.

C—Once again, Your Honors should note the Municipalidad’s omissions. That report concerns a complaint that I filed with MINAE regarding the depression located on the EAST side, as the report itself states—a MINIMAL depression (see Anexo 1)—which has already been altered by the neighbor using tractors so that he may continue building and have water outlets on both sides of his property. As stated, this is a dispute between neighbors that is already being heard by the Agrarian Court (Tribunal agrario). It is not the same situation at issue in this appeal; it is not the same channel caused by the waters from the entire community of la Colonia being discharged on the WEST side, which could never be a natural depression because it was caused by the improper administrative conduct of the Municipalidad de Pococí, and which washes away the land day after day, leaving all types of contamination in its wake.

D. Once again, it seeks to cause confusion by referring to another situation rather than the one at issue in this appeal. At no time have I referred to the neighbor’s stormwater and contaminated water on the east side; I mention those waters only to inform Your Honors that the neighbor whose property is crossed by the municipal drainage system on the west side—where all types of water and waste are already discharged—also takes advantage of this situation to channel water across the entire front of my house from east to west, even though the RIO also crosses his property and he has a public street in front, claiming that because community waters flow there, he has the right to do so. In this way, he avoids having to discharge them onto the public street and instead aggravates the existing problem. However, these are two different situations and are not the matter at issue in this appeal. The authorities of the municipal corporation are fully aware of the problem involving the stormwater described above, which is the water identified in this appeal and which endangers the health and physical integrity of the neighbors and my family.

The Municipalidad disregards the truth and disrespects the Sala by lying in that manner. The temporary drainage system that they installed for the property’s former owners collapsed; I did NOT cause it, and I have NEVER said anything of the sort. As repeatedly stated in writing, I requested that due process (debido proceso) be followed, yet received no response for years. Nevertheless, it should be noted that when Nombre04 went to the Municipalidad, they responded that same day and almost immediately, because it is not in that neighbor’s interest for those waters to be removed, since he uses that route to drain all the water from his rental houses without having to discharge it onto the street or into a tributary. The favoritism has been such that I have had to resort to this Sala Constitucional to enforce my rights as a person and a Costa Rican citizen.

E—Yes, indeed, Honorable Justices, the community now has paved streets and a drainage system through which the water could continue until it is discharged into a natural tributary without invading private property, or it could be properly treated. But that is not what occurs; instead, the waters are intentionally diverted. Nor do they overflow and flow naturally; rather, they are deliberately diverted toward private lots without any study or infrastructure, much less the required legal process. The Municipalidad expects us and our property to handle all the waters and the residential settlement from the center of la Colonia, in complete violation of the rights enshrined in our Political Constitution and human rights.

F—Regarding the response to our request:

First: Your Honors, I am not asking the Municipalidad to eliminate private waste and water, but rather the water and waste for which the State is responsible. What I ask is that it use the public drainage system for the purpose for which it was created and remove the diversion toward my property that has caused so much damage, since the Municipalidad has the infrastructure to convey its waters, as it itself acknowledges.

Within the framework of the Social and Democratic State Governed by the Rule of Law (Estado Social y Democrático de Derecho), Economic, Social, and Cultural Rights (Derechos Económicos Sociales y Culturales) have the fundamental objective of guaranteeing the economic well-being and development of human beings and peoples. Accordingly, entitlement rights (derechos prestaciones) require general State action to meet individual or collective needs. Meeting those needs entails creating the necessary conditions and undertaking to progressively achieve their enjoyment. Such rights are found in Article 50 of the Political Constitution and Article 26 of the American Convention on Human Rights. In the development, protection, and full enjoyment of the aforementioned rights, the role of the Municipalidades and their bodies is particularly important because, pursuant to Article 169 of the Constitution, they are obligated to effectively provide the public services entrusted to them. Thus, as applicable to this specific case, those obligations entail the effective maintenance of public roads and drainage systems, through which other rights are exercised and enjoyed, such as freedom of movement, health, and the right to a healthy environment.

Second: The taking (enajenación) of the property by the Municipalidad de Pococí—not by the neighbor, as the municipal report states—the physical acts and the omissions caused damage to the land, not to the residence, as the Municipalidad would have it appear. I consider myself protected by Article 34 of the Political Constitution, which protects “vested property rights” (derechos patrimoniales adquiridos). Article 41 of the Political Constitution establishes a fundamental right to compensation (derecho fundamental resarcitorio) in favor of a person subject to the Administration (administrado) who has suffered unlawful harm (lesión antijurídica) caused by a public entity—through its normal or abnormal operation or its lawful or unlawful conduct—and the entity’s corresponding obligation to provide full compensation or reparation... Article 45 of the Magna Carta embraces the principle of the inviolability of property (intangibilidad del patrimonio) by providing that “Property is inviolable; no one may be deprived of it except for a legally proven public interest and after compensation in accordance with the law (…)” Furthermore, the financial liability of the Public Administration (responsabilidad patrimonial de la Administración Pública) is guaranteed in our legal system through a series of constitutional provisions, including those established in Articles 9, 11, 18, 33, 41, 45 and 49 of the Fundamental Charter (to mention only some of those concerning that guarantee).

Those provisions contain principles related to efficiency, accountability, distributive justice, the right to the integrity of one’s assets, the right to compensation for harm suffered, and judicial review of administrative action.

Third: Once again, Honorable Justices, the institution insists that these are stormwaters from the property, even though it is fully aware that they are wastewater (aguas residuales) from the community, diverted without any study and without any legal process. It states that each owner should conduct a study, even though it well knows that the waters are municipal and that the Public Administration is responsible for addressing infrastructure problems that may endanger people’s lives, physical integrity, and health, as in this case, where there is an improperly channeled structure directed toward private property (see Anexo 2), resulting from improper conduct by the Municipalidad de Pococí.

The Municipal Institution deliberately diverts the Sala Constitucional’s attention toward other waters and situations that fall within municipal jurisdiction in order to prejudice a fair adjudication of its improper conduct. I must also state that the photographs supplied by the entity do not depict my house; they do depict the channel created by the large volume of water diverted by the Municipalidad. It was not raining at that time, but when it rains, the water becomes a current that carries all types of contamination, as stated above. The other outlet is an agricultural/access easement (servidumbre agrícola/de paso) located within my property. That is where the greatest harm occurs and where water from the entire community enters through the drainage system after being diverted, as shown in the attached images, by means of drain inlets placed on the public road to divert the waters, which the institution negligently fails to show (see Anexo 2).

G—The Municipalidad never informed me of its visit and deliberately took photographs that do not show the actual context.”

  1. 7By order issued at 12:15 on 1o de noviembre del 2022, the Área Rectora de Salud de Pococí was granted a hearing (audiencia).
  2. 8In a written submission added to this case file on 10 de noviembre del 2022, Karen Mayorga Quirós, Director of the Área Rectora de Salud de Pococí, submitted her report. She stated the following:

“FIRST: Public health is an interest protected by the State, as provided in the Ley General de Salud.

SECOND: The health authorities intervened in that community in 2020 and found that there is no stormwater drainage system (alcantarillado pluvial) for removing rainwater, as recorded in report MS-DRRSHC-ARSP-10186-2020 at the appropriate procedural stage.

THIRD: In addressing this amparo appeal (recurso de amparo), an assessment of the site was conducted, and the affected community does not have a stormwater drainage system.

FOURTH: That some homes in the surrounding area have blocked the flow of rainwater that previously ran through their properties.

FIFTH: That there are new residential buildings in the area, which have had a greater impact because they have blocked the channels through which this water previously flowed, causing greater ponding on her property, since it is located on the lower-lying property.

SIXTH: That, for purposes of clarification, this stormwater flows between private properties belonging to neighboring families, who, through agreements among neighbors, allowed it to pass through their properties, since the local Municipality has not conducted the topographic surveys necessary to determine, with scientific and legal certainty, the construction of the stormwater drainage system (sistema alcantarillado pluvial), as it is legally required to do on public roads. SEVENTH: That, in the course of our actions, the situation was brought to the attention of the Local Municipality through official letter MS-DRRSHC-ARSP- 0589-2021.

EIGHTH: That, through official letter SPCA-215-2022, the local Municipality responded:

“Because the situation affecting the complainant neighbors is caused by water originating from Dirección02, and should the Municipality decide to invest in resolving the problem, this would be done through channeling works under the responsibility of the Public Works process, the case is hereby referred, and it is recommended that a meeting be requested with CONAVI officials and with the Urban Planning and Development process in order to reach a better determination.” (The boldface is ours and is intended to highlight the context).

NINTH: That, by email sent by this Área Rectora to the municipal entity, dated 07 de noviembre de los corrientes as part of its accountability reporting and to provide further information to that Honorable Chamber, we were told that “said action remains pending resolution.” (Email dated 08 de noviembre 2022.)”.

  1. 9By a decision issued at 14:45 hours on 14 de noviembre del 2022, the Directora del Área Rectora de Salud de Pococí was asked to supplement the report.
  2. 10In a filing added to this case record (expediente) on 18 de noviembre del 2022, Karen Mayorga Quirós, Directora del Área Rectora de Salud de Pococí, submitted the report. She stated the following:

“FIRST: That public health is a legally protected interest safeguarded by the State, as provided in the Ley General de Salud.

SECOND: That, during that assessment, very dirty water with repulsive odors and inorganic waste being carried along was observed, causing ponding on a public road.

THIRD: That, at the outlet of that drainage system onto the agricultural easement (servidumbre agrícola), such water overflows and accumulates in a ditch running parallel to the southern boundary of the appellant’s property, because it is retained by a wall approximately 60 cm high, thereby causing ponding that affects her property.

FOURTH: That, because there are new residential buildings in the area, which have had a greater impact because they have blocked the channels through which this water previously flowed freely, even greater ponding occurs on her property, since it is located on the lower-lying property.

FIFTH: That, in addressing complaint consecutive number 310-2020, dated 16/09/2020, filed by the appellant before the Área Rectora de Salud, the site was visited at that time. A technical opinion was issued through report MS-DRRSHC-ARSP-10186-2020, which was served on the Alcalde Municipal through official letter MS-DRRSHC-ARSP-0589-2021, by email; it was attached to the previous response submitted to the Sala Constitucional, and I identify the case record as supporting evidence.

SIXTH: That, through official letter SPCA-215-2022, the local Municipality responded:

“Because the situation affecting the complainant neighbors is caused by water originating from Dirección02,and should the Municipality decide to invest in resolving the problem, this would be done through channeling works under the responsibility of the Public Works process, the case is hereby referred, and it is recommended that a meeting be requested with CONAVI officials and with the Urban Planning and Development process in order to reach a better determination.” (The boldface is ours and is intended to highlight the context).

SEVENTH: That, as of this date, the local Municipality has submitted a response stating “that said action remains pending resolution.” (Email dated 08 de Noviembre 2022). Those powers fall exclusively within municipal jurisdiction.

EIGHTH: That, although no sanitary orders (órdenes sanitarias) were issued to the Municipality, it was duly notified of the administrative act (acto administrativo) concerning the environmental problem; accordingly, the appropriate follow-up will be conducted as part of the Municipality’s accountability reporting.

NINTH: That our governing authority has determined that there is a constant flow of water at the site in the stormwater drainage ditch (cuneta de evacuación pluvial) from Dirección03,to the location of the appellant’s inspection chamber (caja de registro); it is therefore inferred that the water flowing through it originates from domestic and commercial activities in the southern sector (central San Rafael de La Colonia),and continues along its course through private properties without sanitary control, until such time as the local government constructs an engineering works design that definitively resolves the stormwater situation causing ponding on the appellant’s property.”

  1. 11The legal requirements have been observed in the proceedings conducted.

Justice Cruz Castro drafts the opinion; and,

Whereas:

I.The allegations could constitute a violation of the right to prompt and effective administrative justice. In this regard, it should be clarified that, beginning with decision number 2008-02545 issued at 8:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa), with certain exceptions, those matters involving disputes over whether the public administration complied with the time limits established by the Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding—initiated ex officio (de oficio) or at the request of a party (a instancia de parte)—through a final administrative act, or to adjudicate the applicable administrative appeals (recursos administrativos). This appeal presents precisely such an exception, because it concerns complaints regarding possible pollution problems and impacts on health.

II. SUBJECT MATTER

The appellant stated that she lives in a residence located in La Colonia de Pococí, Guápiles. She alleges that, due to the lack of municipal drainage, rainwater has long been diverted toward properties neighboring hers, where additional polluted water from several houses is discharged into it and all types of waste accumulate. The resulting flow ultimately drains, among other places, onto the property where she lives. When it rains, this water overflows, contaminates all the properties, and floods the property where she lives. She asserts that she has raised the problem with the Municipalidad and the Ministerio de Salud but has obtained no results.

III. PROVEN FACTS

The following facts relevant to deciding this matter are deemed duly established:

  • 1)The appellant lives in a residence located at Dirección02 (undisputed).
  • 2)There is no stormwater drainage at the location, and consequently the water flows through a ditch crossing several properties, including that of the appellant, which is located on a lower-lying property (report of the Área Rectora de Salud de Pococí).
  • 3)In 2020, the appellant reported to the Ministerio de Salud the absence of stormwater drainage and the fact that local residents use the flow to discharge wastewater (aguas residuales) (documentation submitted and report of the Área Rectora de Salud de Pococí).
  • 4)On 20 de agosto del 2022, she reported to the Municipalidad de Pococí that several residences were discharging wastewater into the stormwater flow (report submitted).
  • 5)On 28 de enero del 2021, after verifying the absence of drainage, the Área Rectora de Salud de Pococí informed the Municipalidad de Pococí of the reported matter (report submitted and documentation provided).
  • 6)On 23 de mayo del 2022, the appellant once again brought the situation to the attention of the Municipalidad de Pococí (report submitted).
  • 7)In 2022, on an unspecified date, the Municipalidad de Pococí responded to the Área Rectora de Salud de Pococí that the stormwater problem must be resolved jointly with CONAVI. In addition, the Municipalidad takes the position that the problem originates from disputes among neighbors and from actions taken by the appellant herself (reports submitted).
  • 8)The Área Rectora de Salud de Pococí has not issued any sanitary order, although it has verified a problem involving wastewater with repulsive odors and waste being carried along (report submitted).
  • 9)Although the water flows through the property where the appellant lives, it has not damaged the residence (appellant’s reply to the Alcalde’s report).

IV. UNPROVEN FACTS

The following facts relevant to resolving these proceedings are deemed not to have been established:

  • 1)That the Área Rectora de Salud de Pococí notified the appellant of the outcome of the complaint filed.
  • 2)That the Municipalidad de Pococí notified the appellant of the outcome of the complaint filed.

V.Merits. With respect to the issue presented, this Chamber has ruled on numerous occasions. Recently, in judgment 2022003203 issued at 9:30 hours on 11 de febrero del 2022, citing its own case law, it stated the following:

“Regarding the right to health and to a healthy and ecologically balanced environment. First, it should be noted that the fundamental rights to health and to a healthy and ecologically balanced environment are constitutionally recognized (articles 21, 50, 73 and 89 of the Constitución Política), as well as recognized through the international legal provisions applicable in Costa Rica. In this regard, in judgment no. 2006-5928 issued at 15:00 hours on 02 de mayo del 2006, this Court ruled:

“The right to life recognized in section 21 of the Constitution is the cornerstone upon which the remaining fundamental rights of the inhabitants of the Republic rest. Likewise, the right to health is grounded in that provision of the political charter, since life is inconceivable unless human beings are guaranteed the minimum conditions necessary for proper and harmonious psychological, physical, and environmental well-being. Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in articles 21, 50, 73 and 89 of the Constitución Política. Specifically, constitutional article 50 expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of the foregoing, this Court has employed the concept of ‘environmental quality’ (calidad ambiental) as a measure of people’s quality of life, precisely, in conjunction with other elements such as health, food, work, and housing, referring to the fact that every person has the right to use the environment for their own development, but not without limits, since there is also a duty to protect and preserve the environment for present and future generations—the principle of sustainable development (principio de desarrollo sostenible)—.” Likewise, article 50 of the Constitución Política establishes the State’s obligation to protect the environment. That provision establishes as follows:

“The State shall seek the greatest welfare for all inhabitants of the country by organizing and stimulating production and the most appropriate distribution of wealth. Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek reparation for the harm caused. The State shall guarantee, defend, and preserve that right. The law shall establish the corresponding liabilities and penalties.” This confirms that the various public authorities have an unavoidable duty to preserve, defend, and guarantee every person’s fundamental right to health and to a healthy and ecologically balanced environment.”

VI.Specific case. According to the reports submitted under oath, subject to the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction, it has been established that the petitioner lives in a house located in La Colonia de Pococí de Guápiles. There is no stormwater drainage system (alcantarillado pluvial) at that location, and consequently the water flows through a ditch crossing several properties, including that of the petitioner, which is situated on lower-lying land (fundo inferior). In 2020, the petitioner reported to the Ministerio de Salud the absence of a stormwater drainage system and the fact that local residents use the watercourse to discharge wastewater (aguas residuales). On 20 de agosto del 2022, she reported to the Municipalidad de Pococí that several dwellings were discharging wastewater into the stormwater flow. On 28 de enero del 2021, after verifying the absence of a drainage system, the Área Rectora de Salud de Pococí notified the Municipalidad de Pococí of the matter reported.

On 23 de mayo del 2022, the petitioner again brought the situation to the attention of the Municipalidad de Pococí. In 2022, on an unspecified date, the Municipalidad de Pococí responded to the Área Rectora de Salud de Pococí that the stormwater problem had to be resolved jointly with CONAVI. In addition, the Municipality takes the position that the problem stems from disputes among neighbors and from actions by the petitioner herself. The Área Rectora de Salud de Pococí has not issued any health order (orden sanitaria), even though it has verified a wastewater problem involving repulsive odors and the carrying of waste. Although the water flows through the land where the petitioner lives, it has not caused damage to the dwelling. Moreover, there is no evidence that the Área Rectora de Salud de Pococí or the Municipalidad de Pococí notified the petitioner of the outcome of the complaint filed.

VII.Several matters must be distinguished from the foregoing. First, the lack of a stormwater drainage system. Second, the discharge of wastewater. Third, the potential dispute among neighbors arising both from the actions of the neighbors and those of the petitioner herself. Finally, the failure of the respondent authorities to reply to the petitioner.

VIII.It is not for this Chamber to rule on the potential dispute among neighbors. This matter must be heard in ordinary proceedings (vía ordinaria). Jurisdiction over potential noncontractual liability (responsabilidades extracontractuales) lies not with a Constitutional Court but with the ordinary courts.

IX.With regard to the stormwater drainage system, the following must be clarified: it is not for this Chamber to intervene directly in the management of public works. It is not for this Chamber to take the place of the municipal entity and plan the development of local infrastructure. Nevertheless, this Chamber may intervene insofar as the absence of infrastructure creates a health problem or environmental pollution. In this case, it has not been shown that stormwater is causing such problems. The pollution problem arises from wastewater. It may ultimately be the case that constructing a drainage system would eliminate the possibility of discharging wastewater into the stormwater flow; however, a stormwater drainage system is not intended to collect wastewater, and the absence of such a system does not authorize the discharge of wastewater into the stormwater flow. In addition, it must be noted that the petitioner herself acknowledges in her reply brief (escrito de réplica) that, although the water flow affects the land, it does not affect the dwelling.

This is not the proceeding in which to determine whether, because the water is stormwater, the lower-lying land must bear it. It must also be added that, in this case, there is a dispute not only as to precisely what infrastructure is required but also as to the entities responsible for constructing it. Finally, the Municipality correctly notes that public infrastructure works may not be constructed on private property and even alleges that part of the problem stems from actions taken by the petitioner herself. The Municipality further considers that construction was undertaken without a permit, none of which may be adjudicated in amparo proceedings (vía del amparo). In short, it is not appropriate here to order construction of the drainage system or the compensation sought by the petitioner. On this issue, the petition must be denied.

X.By contrast, the Área Rectora de Salud de Pococí acknowledges that wastewater is flowing through the area but has not issued any health order in that regard. It is quite clear that it is not for this Chamber to issue such orders directly, but it may review the failure of the responsible entity to act. It is true that the Área Rectora de Salud de Pococí forwarded the complaint filed in 2020 to the Municipalidad de Pococí so that the latter could address it. However, the responsibility of the Ministerio de Salud is not limited merely to forwarding a complaint; it must examine the matters raised and, within the scope of its powers, issue the appropriate orders against whoever is determined to be causing the pollution problem. Because of the failure of the Ministerio de Salud to act, the petition must be granted against it, with the consequences set forth in the operative portion (parte dispositiva). It must also be noted that it is not for this Chamber to review the technical appropriateness of any measures that the Ministerio de Salud may ultimately order.

XI.Finally, with regard to the failure to respond, this is a matter that this Court may adjudicate because, as explained at the outset, it concerns a complaint regarding pollution that is also related to a potential impact on health. On this issue, there is no evidence that the Municipality or the Área Rectora de Salud de Pococí responded. Although the Ministerio de Salud refers to the confidential nature of the complaint, the complaint is not anonymous. Both institutions have a duty to provide a response, even if they do not grant the petitioner the relief she seeks. In other words, if the authorities consider the complaint unfounded, they must inform the complainant accordingly. There is no evidence that they did so. Consequently, the petition must also be granted on this issue.

XII.NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE (JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA). I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), jurisdiction over the legal dispute lies with the Contentious-Administrative Courts and not with this Chamber. Nevertheless, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right may receive judicial protection through the writ of amparo (recurso de amparo) established by Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in cases in which the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights.

In my view, the recently enacted legislation does not require this Court to modify its line of precedent, since, pursuant to section 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional cases that may properly be heard in this jurisdiction through the constitutional proceeding guaranteeing amparo, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 of 8:55 hours on 22 de febrero de 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction, all of which is consistent with section 25 of the Convención Americana sobre Derechos Humanos, Constitutional Law (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.

XIII.Partial dissent (voto salvado parcial) by Justice Garro Vargas concerning the operative portion of this judgment. Although I agree with the majority of the Chamber that the petition should be granted, I disagree as to the forum in which the enforcement phase of the matter should be conducted, because the rules governing this constitutional jurisdiction do not provide adequate mechanisms for monitoring compliance with a judgment involving highly complex technical matters, as in this case, where wastewater pollution must be verified and the appropriate health orders issued within six months. By contrast, the enforcement provisions of the Código Procesal Contencioso-Administrativo (Article 155 et seq.) offer clear advantages, such as the ability to require timelines, impose fines, establish liability, monitor stages of compliance, and so forth. Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.

XIV. DOCUMENTATION SUBMITTED TO THE CASE FILE (EXPEDIENTE)

The petitioner is hereby advised that, if she submitted any paper document, as well as any objects or evidence contained on any additional electronic, computing, magnetic, optical, or telematic device or produced using new technologies, she must retrieve them from the Court Clerk’s Office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within this period shall be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session number 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial at session number 43-12 held on 3 de mayo del 2012, Article LXXXI.

POR TANTO:

The petition is partially granted solely on the grounds of the failure to respond to the complaints and the failure of the Ministry of Health to intervene. Consequently, Karen Mayorga Quirós, Director of the Pococí Governing Health Area, or whoever holds that position, is ordered to take the necessary steps so that, within six months of service of this judgment, the wastewater contamination is verified and the pertinent health orders (órdenes sanitarias) are issued. Likewise, Karen Mayorga Quirós, Director of the Pococí Governing Health Area, or whoever holds that position, and Manuel Hernández Rivera, Municipal Mayor of Pococí, or whoever holds that position, are ordered, within five business days of service of this judgment, to provide the petitioner (recurrente) with a response to the complaints filed with that Health Area and the Municipality, respectively. They are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding (recurso de amparo) that the person must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be sentenced to imprisonment for three months to two years, or to a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The State and the Municipalidad de Pococí are ordered to pay the legal costs, damages, and losses caused by the acts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction (jurisdicción de lo contencioso administrativo). In all other respects, the petition is denied. Justice Castillo Víquez adds a note. Justice Garro Vargas dissents with respect to the enforcement of this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, determines that enforcement must be carried out before the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in Article 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be transmitted so that proceedings to enforce this ruling may be commenced. Let notice be served.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dos de diciembre de dos mil veintidos .

Recurso de amparo interpuesto por Nombre01, cédula de identidad número CED01, contra la Municipalidad de Pococí y contra el Ministerio de Salud.

RESULTANDO:

  1. 1Por escrito agregado a este expediente el 3 de octubre del 2022, la recurrente alegó, en resumen, que desde abril de 2019, debido a un contrato de opción de compra venta suscrito por su hijo y que finalmente se formalizó el 28 de abril de 2021, su persona habita una vivienda que se ubica en La Colonia de Pococí, Guápiles, la cual forma parte de la propiedad con el DERECHO CERO CERO DOS, adquirido por su hijo, equivalente a siete octavos en la finca del partido de Limón, matrícula de , con una cabida de cuatro mil trescientos quince metros y treinta decímetros cuadrados. Expone que como su persona habitaba en calidad de dueña desde abril de 2019, se dio a la tarea de limpiar toda el área correspondiente al derecho antes referido, pues todo estaba lleno de mucha vegetación, residuos, vidrios, zapatos, botellas, en general todo residuo sólido, incluyendo la servidumbre agrícola que le sirve de acceso, y en la que entonces había muchos residuos.Narra que cuando comenzaron las lluvias, como es característico de la zona, observó que el inmueble desfoga aguas municipales agregadas por el colindante, las cuales no solo son las pluviales, sino también contaminadas de aguas servidas y negras-, notoriamente visibles y malolientes que arrastran toda clase de residuos sólidos como son pañales, condones, mascarillas, vidrios, botas entre otros. Explica que esta situación ha convertido parte de dicho inmueble en un terreno encharcado, sin salida a calle publica con sus consiguientes implicaciones para la salud humana, peligro de la integridad física y proliferación de los insectos. Indica que la propiedad matrícula de no soporta una servidumbre municipal de aguas. Refiere que fue la propiedad colindante sur que firmo voluntariamente hace muchos años, un permiso provisional para que la municipalidad desviara por ahí sus aguas, mientras se pavimentaba la calle, porque al ser de lastre se lavaba el material.Describe que en esa época la población era pequeña y no ocurrían los problemas de rebalse e inundación que se aprecian hoy día. Añade que la propiedad original que firmó el permiso se fue dividiendo entre la familia y cada uno construyó su casa, para lo cual la Municipalidad otorgó los permisos de construcción pertinentes, de modo que las casas se construyeron sobre el paso del alcantarillado que desecha todas sus aguas hacia la propiedad de mi familia, justificando que son canales públicos y hace toda la contaminación de la comunidad viene a parar al patio de su casa. En consecuencia, refiere que su casa y terreno se inundan por el rebalse del agua, cada vez que llueve con el perjuicio económico, porque el terreno se ha lavado y deteriorado, entonces no es posible cultivarlo y también perjuicio en la salud e integridad física. Afirma que lleva tres años de vivir en la propiedad y en reiteradas ocasiones ha planteado el problema ante la Municipalidad, también por medio del Ministerio de Salud, pero no ha logrado nada, pese a que cuando llueve se rebalsa, salen aguas contaminadas que afectan la salud y seguridad de su familia, ya que posterior a la lluvia quedan aguas estancadas y residuos peligrosos.Detalla que el 20 de agosto 2020, vía correo electrónico puso en conocimiento las construcciones y la problemática de aguas, sin recibir respuesta; el 28 de agosto escribió a la municipalidad por medio de las plataformas sociales para hacer de su conocimiento el desbordamiento de las aguas y pedir se le indicara una vía formal o legal para las respectivas denuncias, ya que por motivos del COVID 19 no podía asistir presencialmente. Señala que se autorizaron otras vías virtuales como medios legales para la comunicaron con las instituciones como medidas de emergencia y la refirieron a un WhatsApp. Agrega que en el primer trimestre del 2021 se apersonó en la propiedad de su familia personal del Departamento de Gestión Ambiental por primera vez, realizó la inspección y verbalmente le dijeron que se daría solución por medio del Departamento de Obras Civiles y que pronto sería visitada por dichos funcionarios; sin embargo, no ha sucedido nada.Relata que el 28 de agosto 2021 como resultado de una gestión ante el Ministerio de Salud, se dio traslado a la municipalidad de dicha situación y desde el 24 de agosto del 2020 mantiene comunicación vía WhatsApp con la municipalidad acatando las medidas del Ministerio de Salud, ha enviado fotos y videos y no recibe respuesta a su solicitud de solucionar el problema. Manifiesta que el 10 de mayo recibió por segunda ocasión visita del Departamento de Gestión Ambiental de la Municipalidad de Pococí, y le dijeron que buscarían la mejor solución posible. Posteriormente, el 23 de mayo de 2022, planteó una solicitud por escrito ante la municipalidad, para que solucionen el problema, y únicamente le contestaron que se reunirían con el CONAVI para buscar una solución, pero no sucede. Argumenta que la propiedad no tiene establecida servidumbre alguna a favor de la municipalidad de Pococí, corporación que nunca ha creado infraestructura alguna para canalizar esas aguas obligándola a ella y a sus hijos a "nadar" en medio de vidrios, basura y contaminación, que pone en riesgo la salud.Alega que los niños tienen que "sortear" los obstáculos para asistir al colegio y demás diligencias, debido a la acumulación de aguas. Por otra parte, aduce que la agricultura se ve muy afectada ya que los sembradíos se deterioran por la contaminación y los animales domésticos se enferman y mueren al consumir aguas sucias y malolientes. Solicita se le ordene a la municipalidad de Pococí eliminar por completo las aguas y residuos de la propiedad, ya que actualmente la comunidad tiene calles asfaltadas con sistemas de alcantarillados y cunetas. Además pide se condene a reparar el daño material ocasionado y subsidiariamente, si no fuera posible la eliminación por completo de la aguas y que la única vía es por la propiedad de mi representado, se le ordene a la Municipalidad de Pococí estudio topográfico y de impacto ambiental y los permisos correspondientes expedidos por la Secretaría Técnica Nacional Ambiental y el Ministerio de Salud, respecto a la viabilidad de la obra, que se le informe con relación a la oficina de ingeniería de la municipalidad, en cuanto al diseño y construcción del alcantarillado, así como el resarcimiento económico o material de los daños.
  2. 2Por resolución de las 10:39 horas del 5 de octubre del 2022, se previno a la recurrente firmar el escrito de interposición o ratificar lo allí expuesto.
  3. 3Por escrito agregado a este expediente el 6 de octubre del 2022, la recurrente ratificó lo alegado en el escrito de interposición.
  4. 4Por resolución de las 15:05 horas del 6 de octubre del 2022, se le dio curso al proceso, lo que se notificó a la Municipalidad de Pococí el 13 de octubre del 2022.
  5. 5Por escrito agregado a este expediente el 18 de octubre del 2022, Manuel Hernández Rivera, Alcalde Municipal, y Jazlyn Morales Grajal, Presidente del Concejo Municipal, ambos del Municipalidad de Pococí, rindieron el informe. Indicaron lo siguiente:

“INFORME:

Los hechos que alega el recurrente, son respecto al FOLIO REAL 7 118.583-002, Dirección01, PLANO: L-1054201-2006, según información emitida por el Registro Nacional, dicho inmueble es de Naturaleza: DE REPASTO. Adquirió el terreno, mediante compra, el día el 22 de mayo 2021 colinda al NORTE con Nombre02; SUR con SERVIDUMBRE AGRÍCOLA (7m de ancho) en medio y Nombre03: al ESTE con lote 9; y, al OESTE, colinda con lote 7 y SERVIDUMBRE DE PASO con un frente de 5m de ancho.

Según información emitida por el Departamento de Control Constructivo, no se ha tramitado NINGUN PERMISO DE CONSTRUCCION, en dicho inmueble. Lo que significa que en dicho inmueble NO HAY CASA DE HABITACION, o bien, el recurrente ha construido sin tramitar permiso de construcción, lo que conlleva que probablemente no se han respetado los 15m de retiro mínimo para construir; respecto al río que atraviesa su propiedad, y que dicho sea de paso, cabe mencionar, que es uno de los principales ríos que frecuentemente provocan inundaciones en nuestro cantón, especialmente en las zona de la bajura, tales como lo es la comunidad de La Colonia, Balastre, La Teresa, Ticaban y otros sectores, aunado a ello, recordemos que los ríos mismos. se encargan de recuperar su cauce, Este río se indica en el plano catastrado aportado.

Como puede notarse, este inmueble fue adquirido en mayo del año pasado, no colinda frente a calle pública, y otra situación de gran relevancia, es que las aguas corren buscando el río que atraviesa su terreno, esto debido a la topografía del inmueble; esta depresión natural se encuentra clasificada como tal, en el Oficio emitido por la Dirección de Aguas, en su Oficio DA-UHCAROG-0857-2019 (referente a un trámite de visado de plano de un vecino).

Y tal como lo indica el Oficio de la INSPECCION DE CAMPO, de MAYO DE 2021, emitido por el Ing. Fabián Delgado, la señora había manifestado que ella misma bloqueó el paso de alcantarilla, ya que su terreno no soporta ningún gravamen de servidumbre de agua, situación que provoca las inundaciones en su propiedad.

De acuerdo al Oficio UTGAM-0282-2021 del 24 de mayo de 2021 de la Oficina de Gestión Ambiental Municipal, se indica lo siguiente:

“… Durante la inspección se evidencia un estancamiento de aguas aparentemente de escorrentía en la propiedad del señor Nombre04, esto debido a que la señora Nombre01 rellenó el supuesto paso de aguas, No se percibe a simple vista que estas aguas sean residuales. ...”.

Sin duda alguna, estamos ante un conflicto vecinal (privado), y siendo que este terreno no colinda frente a calle pública, sino que su salida es a través de una SERVIDUMBRE de paso, al sur, la cual sale a la Dirección02, esta carretera, se encuentra debidamente asfaltada (por CONAVI), con sus respectivas cunetas y alcantarillado. Esta es una parcela agrícola atravesada, por el río San Rafael, tal como se puede apreciar en el plano catastrado que se adjunta con el informe del ingeniero municipal del Área de Control Constructivo.

Así las cosas, sin duda es un caso donde los colindantes deben realizar Un ESTUDIO DE TOPOGRAFÍA para IDENTIFICAR el punto de desfogue, DETERMINAR de dónde vienen las GUAS PLUVIALES; hacer un levantamiento taquimétrico, con ello se podrá determinar el diseño de las tuberías o alcantarillado, dependiendo de la información que arroje dicho informe técnico topográfico.

En cuanto a la pretensión de los recurrentes.

Primera: Solicitan que se nos ordene eliminar por completo las aguas y residuos de su propiedad.

Esto implicaría realizar obra pública dentro de un terreno privado lo que acarrearía grandes consecuencias negativas, pues como es bien sabido, no se puede invertir recursos públicos de esa manera.

Segunda: Que se nos condenen a repare el daño material ocasionado.

Hace referencia a que su casa de habitación y su terreno se inunda, no obstante la vivienda no cuenta con permiso de construcción alguno, además su inmueble es un terreno de repasto, que no colinda con ninguna calle pública. por otra parte, el conflicto existente, es con respecto a su colindante, debido a que recibe las aguas pluviales, las cuales se enrumban hacia el río San Rafael, el cual atraviesa su propiedad.

Tercera: Otra de sus pretensiones, consiste en que, si no se puede eliminar por completo las aguas y que si es la única vía su propiedad, que se ordene un estudio topográfico y de impacto ambiental; y que se le informe el diseño y construcción de la obra de alcantarillado; así como el respectivo resarcimiento económico. Una vez más, pretende que este gobierno local, realice inversión de fondos públicos en su propiedad, pues considera esta representación que cada uno de los interesados es quien debería contratar los servicios profesionales de un topógrafo para que realice el estudio respectivo, para encausar debidamente las aguas pluviales en su propiedad”.

  1. 6Por escrito agregado a este expediente el 26 de octubre del 2022, la recurrente manifestó lo siguiente:

“Con el debido respeto manifiesto: Expreso agravios a contestación en informe por parte de la Municipalidad de Pococí, atendiendo el orden en que formula su contestación. En escrito aparte se complementa la presente exposición y se aporta anexo con imágenes de con contraprueba de las afirmaciones expuestas en el informe de dicha institución.

A-Señores magistrados la exposición de la Municipalidad solo pretende confundir la realidad material subsistente desviando la atención hacia los permisos de construcción, debo mencionar que en el inmueble SI HAY CASA DE HABITACION, desde hace más de 30 años en este inmueble, existe dicho inmueble desde antes de la división material de la finca 7-00017078 (finca madre) la cual se divide y da origen a la finca 7-000 118583 , esta era la única casa que tenía la finca madre y al dividirse en lotes este quedo con el inmueble ya construido, y el anterior propietario le realizó mejoras. Como se mencionó la adquisición de lote ya contaba con la casa de habitación, por lo tanto, no se debió gestionar permiso de construcción alguno.

B- Otra vez señores magistrados se puede notar la falta de interés que ha tenido la institución en la problemática, donde indica que “probablemente” no se han respetado los 15 metros de retiro para construir, colocando en un documento oficial un supuesto, debo indicar que la casa está a más de 25 del Rio San Rafael en su parte más cerca y a más de 45 metros en la más alejada, respetando el margen de retiro y gracias a Dios nunca dicho rio se ha salido en este espacio de terreno. Por otra parte, es cierto que la propiedad no colinda con calle publica, sino que las aguas son creadas por alcantarillado hasta el inmueble vecino sur y desfogadas en el terreno finca 7-000 118583 y no son de llevarlas al RIO y tampoco discurren hacia el rio sino hacia otros lotes y caserío.

C- Una vez más note su autoridad, las omisiones de la Municipalidad, dicho informe corresponde a denuncia interpuesta por mi persona ante el MINAE por esta depresión situada al lado ESTE como lo indica el mismo, depresión MINIMA (ver Anexo 1), pero ya alterada por el vecino con tractores, para seguir construyendo y tener desfogues de agua por ambos lados de la propiedad suya, como indica es un problema vecinal ya en proceso en el Tribunal agrario. No es la misma situación objeto de este recurso, no es el mismo canal que ha causado las aguas de toda la comunidad de la Colonia desfogadas en el lado OESTE, que jamás podría ser depresión natural ya que es causada por la mala actuación administrativa de la institución Municipalidad de Pococí, que lava el terreno día con día y deja a su paso todo tipo de contaminación.

D. Una vez más pretende confundir refiriéndose a otra situación y no a la que nos ocupa en este recurso, en ningún momento me he referido a las aguas pluviales y contaminadas del vecino por el lado Este, únicamente me refiero a estas para indicarle a su autoridad que el vecino por donde pasa el alcantarillado municipal en su propiedad en el lado oeste, donde ya desfoga todo tipo de agua y residuo, y aunado a esto aprovecha para cruzar todo el frente de mi casa de este a oeste, estando el RIO cruzando también sus propiedad y teniendo calla publica en frente, aludiendo que como corren aguas de la comunidad esto le da derecho a hacerlo, y así no tener que sacarlas a calle publica sino que agrava la problemática ya existente, pero son dos situaciones diferentes y no las que nos ocupa en este recurso. Las autoridades de la corporación municipal tienen pleno conocimiento del problema con las aguas pluviales señaladas anteriormente, las que son señaladas en este recurso y las cuales ponen en riesgo la salud y la integridad de los vecinos y de mi familia.

Falta a la verdad, la Municipalidad y al respeto de la Sala al mentir de esa manera, el alcantarillado provisional que colocaron a los anteriores dueños de la propiedad colapsó, NO fue mi persona quien lo ocasionó, NUNCA he dicho algo como eso, como se manifestó por escrito en reiteradas ocasiones, que se realice el debido proceso, sin tener respuesta por años, sin embargo nótese que cuando Nombre04 acudió a la Municipalidad respondieron el mismo día y casi de inmediato, ya que a dicho Vecino No le conviene quitar esas aguas porque por ahí el desagua todas las agua de sus casas de alquiler sin tener que sacarla a calle o afluente. Es tal el favoritismo que he tenido que recurrir a esta Sala Constitucional para hacer valer mis derechos como persona y ciudadana costarricense.

E- Sí, en efecto señores magistrados, la Comunidad cuenta ya con calles asfaltadas y alcantarillado, donde el agua puede continuar hasta descargarlas en afluente natural sin tener que invadir propiedad privada o darle el debido tratamiento, pero no es así, sino que son desviadas intencionalmente, tampoco se salen discurriendo de forma natural, sino que son desviadas a propósito hacia los lotes privados sin ningún estudio o infraestructura, ni mucho menos el debido proceso legal. La municipalidad pretende que nosotros y nuestra propiedad se encargue de todas las aguas y caserío del centro de la Colonia, en total atropello a los derechos consagrados en nuestra Constitución política y derechos Humanos.

F- En cuanto a la respuesta de nuestra pretensión:

Primero: Su excelencia no estoy pidiendo que elimine la municipalidad residuos y aguas privados sino las aguas y residuos que son responsabilidad del estado, lo que pido es que utilice el alcantarillado público para el fin que fue creado y que quite el desvío hacia mi propiedad que tanto daño a causado, ya que la municipalidad tiene la infraestructura para llevar sus aguas, como ellos mismos lo reconocen.

En el marco del Estado Social y Democrático de Derecho, los Derechos Económicos Sociales y Culturales tienen como objetivo fundamental garantizar el bienestar económico y el desarrollo del ser humano y los pueblos. A partir de esto, los derechos prestaciones demandan la actividad general del Estado para la satisfacción de las necesidades individuales o colectivas. La satisfacción de esas necesidades supone la creación de condiciones necesarias y el compromiso de lograr progresivamente su goce. Encontramos tales derechos en el contenido del artículo 50 de la Constitución Política y el artículo 26 de la Convención Americana sobre Derechos Humanos. En el desarrollo, tutela y pleno disfrute de los derechos de cita, resulta de relevancia la función de la Municipalidades y sus órganos, las cuales, a partir del artículo 169 constitucional, se encuentran en la obligación de prestar en forma efectiva los servicios públicos que les han sido encomendados. Así, de aplicación en el caso concreto, tales obligaciones con llevan el efectivo mantenimiento de las vías públicas y alcantarillado, por medio de las cuales se ejercitan y disfrutan otros derechos, tales como la libertad ambulatoria, la salud y el derecho a un ambiente sano.

Segundo: La enajenación del inmueble por parte de la Municipalidad de Pococí, no las del vecino como el informe municipal lo indica, las actuaciones materiales , las conductas omisivas le causaron daño al terreno, no a la casa de habitación, como quiere dejar ver la Municipalidad, me siento amparada por El artículo 34 de la Constitución Política ampara los “derechos patrimoniales adquiridos” , El numeral 41 de la Constitución Política establece un derecho fundamental resarcitorio a favor del administrado que haya sufrido una lesión antijurídica por un ente –a través de su funcionamiento normal o anormal o su conducta lícita o ilícita- y la obligación correlativa , de éste de resarcirla o repararla de forma integral... El artículo 45 de la Carta Magna acoge el principio de la intangibilidad del patrimonio al disponer que “La propiedad es inviolable; a nadie puede privarse de la suya si no es por interés público legalmente comprobado, previa indemnización conforme a la ley (…) Por otra parte la responsabilidad patrimonial de la Administración Pública es garantizada en nuestro ordenamiento jurídico a través de una serie de preceptos constitucionales, entre ellos, los establecidos en los artículos 9, 11, 18, 33, 41, 45 y 49 de la Carta Fundamental (para mencionar sólo algunos de los que refieren la citada garantía).

Dichos numerales contienen principios relacionados con la eficiencia, la rendición de cuentas, la justicia distributiva, el derecho a la integridad patrimonial, el derecho al resarcimiento de las lesiones sufridas y el control judicial de la actuación administrativa.

Tercero: Otra vez insiste la institución señores magistrados, que son aguas pluviales de la propiedad, donde tiene pleno conocimiento que son aguas residuales de la comunidad, desviadas sin ningún estudio y sin ningún proceso legal. Indica que cada propietario realice un estudio, las aguas, bien sabe que estas son municipales y es responsabilidad de la administración Publica la atención de aquellos problemas de infraestructura que puedan poner en riesgo la vida, integridad y salud de las personas, como es el caso, donde existe un problema de estructura mal canalizada hacia propiedad privada (ver Anexo 2), de mala actuación por parte de la Municipalidad de Pococí.

La Institución Municipal de forma deliberada hace un desvío de atención de la Sala Constitucional a otras aguas y situaciones que son competencia municipal para afectar el juicio justo de la su mala actuación. Debe además indicar que las fotografías suministradas por la entidad no corresponden a mi casa, si corresponde el canal que muestra causado por la gran cantidad de agua que desvía la municipalidad, en ese momento no está lloviendo, pero cuando llueve es una corriente que arrastra todo tipo de contaminación como se indicó anteriormente. Y por la otra salida que es servidumbre agrícola/de paso, que está dentro de mi propiedad, es donde está la mayor afectación y por donde ingresa vía alcantarillado el agua de toda la comunidad desviada como se ve en las imágenes agregadas por medio de ceniceros colocados en la vía pública para desviar las aguas, que negligentemente no lo muestra la institución (ver Anexo 2).

G- La Municipalidad nunca me informo de su visita y tomaron fotos que no muestran el contexto real de forma deliberada”.

  1. 7Por resolución de las 12:15 horas del 1o de noviembre del 2022, se concedió audiencia al Área Rectora de Salud de Pococí.
  2. 8Por escrito agregado a este expediente el 10 de noviembre del 2022, Karen Mayorga Quirós, Directora del Área Rectora de Salud de Pococí, rindió el informe. Indicó lo siguiente:

“PRIMERO: Que la salud pública es un bien tutelado por el Estado así dispuesto en la Ley General de Salud.

SEGUNDO: Que en dicha comunidad se intervino por parte de las autoridades de salud en el año 2020, encontrando que no existe un alcantarillado pluvial para evacuar las aguas de lluvia, consignado mediante informe MS-DRRSHC-ARSP-10186-2020, en el momento procesal oportuno.

TERCERO: Que, en la atención del presente recurso de amparo, se realiza valoración al sitio, y no se cuenta con el alcantarillado pluvial en la comunidad afectada.

CUARTO: Que algunas viviendas del sector aledaño han procedido a cerrar el paso de las aguas de lluvia que con anterioridad circulaban dentro de sus fundos.

QUINTO: Que existen nuevas construcciones de viviendas en el sector, las cuales han generado mayor impacto, pues han procedido a cerrar la pasada de estas aguas, por donde antes circulaban, lo que provoca mayor estancamiento a su propiedad, pues se encuentra en el fundo inferior.

SEXTO: Que para efectos aclaratorios el paso de estas aguas pluviales se da entre propiedades privadas propios de familias aledañas, las cuales mediante acuerdos de vecinos permitían su tránsito a lo interno, pues la Municipalidad local no ha realizado los levantamientos topográficos para determinar con certeza científica y jurídica la construcción del sistema alcantarillado pluvial, como en derecho le corresponde en vía pública. SÉTIMO: Que en nuestras actuaciones se les indicó a la Municipalidad Local la situación mediante el oficio MS-DRRSHC-ARSP- 0589-2021.

OCTAVO: Que mediante oficio SPCA-215-2022 la Municipalidad local responde:

“Debido a que la situación que está afectando a los vecinos denunciantes es producto de aguas que provienen por la Dirección02, y que de ser el caso que la Municipalidad decida invertir en la solución del problema sería a través de obras de canalización competencia del proceso de Obras Pública, se traslada el caso y se recomienda solicitar una reunión con los personeros del CONAVI y con el proceso de Planificación y Desarrollo Urbano para un mejor resolver”. (La negrita es nuestra con fines de resaltar el contexto).

NOVENO: Que, mediante correo electrónico remitido por esta Área Rectora al ente municipal, fechado el 07 de noviembre de los corrientes en rendición de cuentas, para mejor proveer a esa Noble Cámara, nos responden que” dicha acción está pendiente de resolver”. (Correo fechado 08 de noviembre 2022.)”.

  1. 9Por resolución de las 14:45 horas del 14 de noviembre del 2022, se solicitó ampliar el informe a la Directora del Área Rectora de Salud de Pococí.
  2. 10Por escrito agregado a este expediente el 18 de noviembre del 2022, Karen Mayorga Quirós, Directora del Área Rectora de Salud de Pococí, rindió el informe. Indicó lo siguiente:

“PRIMERO: Que la salud pública es un bien tutelado por el Estado así dispuesto en la Ley General de Salud.

SEGUNDO: Que dicha valoración se observó agua muy sucia con olores repulsivos y arrastre de desechos inorgánicos, causando estancamientos en vía pública.

TERCERO: Que, en la salida de ese alcantarillado a la servidumbre agrícola, se desbordan tales aguas y se acumulan en una zanja paralela a la colindancia Sur de la propiedad de la recurrente; pues son retenidas por un muro construido de unos 60 cm de altura, lo que ocasionan un estancamiento que afecta su propiedad CUARTO: Que, al existir nuevas construcciones de viviendas en el sector, las cuales han generado mayor impacto, pues han procedido a cerrar la pasada de estas aguas, por donde antes circulaban libremente, lo que provoca aún mayor estancamiento a su propiedad, ya que se encuentra en el fundo inferior.

QUINTO: Que en la atención de la denuncia número de consecutivo 310-2020, fechada 16/09/2020 interpuesta por la recurrente ante el Área Rectora de Salud, se visitó el sitio en su momento. Emitiendo criterio técnico mediante informe MS-DRRSHC-ARSP-10186-2020, el cual se notificó al Alcalde Municipal en oficio MS-DRRSHC-ARSP-0589-2021, vía correo electrónico, lo cual se adjuntó en la respuesta anterior a la Sala Constitucional, para lo que señalo el expediente como aporte de prueba.

SEXTO: Que mediante oficio SPCA-215-2022 la Municipalidad local responde:

” Debido a que la situación que está afectando a los vecinos denunciantes es producto de aguas que provienen por la Dirección02,y que de ser el caso que la Municipalidad decida invertir en la solución del problema sería a través de obras de canalización competencia del proceso de Obras Pública, se traslada el caso y se recomienda solicitar una reunión con los personeros del CONAVI y con el proceso de Planificación y Desarrollo Urbano para un mejor resolver”.

(La negrita es nuestra con fines de resaltar el contexto).

SÉTIMO: Que a la fecha la Municipalidad local remite respuesta indicando: “que dicha acción está pendiente de resolver”. (Correo fechado 08 de Noviembre 2022). Siendo que dichas competencias son netamente de resorte municipal.

OCTAVO: Que, a pesar de no dictar las órdenes sanitarias a la Municipalidad, si fue notificado debidamente el acto administrativo de la problemática ambiental, por lo que se estará dando el seguimiento pertinente en rendición de cuentas a la Municipalidad.

NOVENO: Que se determina por nuestro ente rector que existe en el sitio un flujo constante de agua en la cuneta de evacuación pluvial de la Dirección03,hasta donde se ubica la caja de registro de la recurrente, por lo que se infiere que las aguas que discurren en ella son originadas por las actividades domésticas y comerciales del sector Sur (centro de San Rafael de La Colonia),y continúan su trayectoria por propiedades privadas sin control sanitario, pues hasta tanto no se construya un diseño de obra de ingeniería por parte del gobierno local que resuelva en definitiva la situación de las aguas pluviales que le causan estancamiento a la propiedad de la recurrente”.

  1. 11En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Cruz Castro; y,

Considerando:

I.Lo planteado podría configurar una lesión al derecho a una justicia administrativa pronta y cumplida. Al respecto, debe aclararse que, a partir del voto número 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa (con algunas excepciones) aquellos asuntos en los que se discuta si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo (incoado de oficio o a instancia de parte) o conocer de los recursos administrativos procedentes. Precisamente, en este recurso, se plantea un supuesto de excepción pues se trata de denuncias por posibles problemas de contaminación y de afectación a la salud.

II. OBJETO

La recurrente manifestó que habita una casa de habitación ubicada en La Colonia de Pococí, Guápiles. Alega que por falta de alcantarillado municipal se desvían desde hace tiempo aguas de lluvia hacia propiedades vecinas a la de ella, en las que, a su vez, se vierten más aguas contaminadas de varias casas y se suman todo tipo de residuos. Al final el caudal desagua, entre otras, en la propiedad en donde ella vive. Cuando llueve, esas aguas se desbordan, contaminan todas las propiedades e inundan la propiedad donde vive. Afirma que ha planteado el problema ante la Municipalidad y ante el Ministerio de Salud, pero no ha logrado nada.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • 1)La recurrente habita una vivienda ubicada en Dirección02 (no controvertido).
  • 2)En el lugar no existe alcantarillado pluvial de manera que las aguas discurren formando una zanja que atraviesa varias propiedades entre ellas la de la recurrente que se encuentra en un fundo inferior (informe del Área Rectora de Salud de Pococí).
  • 3)En el año 2020, la recurrente denunció ante el Ministerio de Salud la ausencia de alcantarillado pluvial y que los vecinos del lugar aprovechan la corriente para verter aguas residuales (documentación aportada e informe del Área Rectora de Salud de Pococí).
  • 4)El 20 de agosto del 2022, denunció ante la Municipalidad de Pococí que varias casas de habitación vertían aguas residuales en la corriente de aguas pluviales (informe rendido).
  • 5)El 28 de enero del 2021, el Área Rectora de Salud de Pococí, tras verificar la ausencia de alcantarillado, puso en conocimiento de la Municipalidad de Pococí lo denunciado (informe rendido y documentación aportada).
  • 6)El 23 de mayo del 2022, la recurrente de nuevo expuso la situación ante la Municipalidad de Pococí (informe rendido).
  • 7)En el año 2022, sin precisar fecha, la Municipalidad de Pococí respondió al Área Rectora de Salud de Pococí que el problema de aguas pluviales debe solucionarse en conjunto con el CONAVI. Además, la Municipalidad es del criterio que el problema se origina por problemas vecinales y acciones de la propia recurrente (informes rendidos).
  • 8)El Área Rectora de Salud de Pococí no ha dictado ninguna orden sanitaria, pese a que ha verificado un problema de aguas residuales con olores repulsivos y arrastre de desechos (informe rendido).
  • 9)Si bien las aguas discurren por el terreno donde vive la recurrente no le ha causado daño a la casa de habitación (réplica al informe del Alcalde presentada por la recurrente).

IV. HECHOS NO PROBADOS

De importancia para resolver este proceso, se tienen por no demostrados los siguientes:

  • 1)Que el Área Rectora de Salud de Pococí hubiera notificado a la recurrente el resultado de la denuncia interpuesta.
  • 2)Que la Municipalidad de Pococí hubiera notificado a la recurrente el resultado de la denuncia interpuesta.

V.Sobre el fondo. En relación con el tema expuesto, esta Sala se ha pronunciado en múltiples oportunidades. Recientemente, en sentencia 2022003203 de las 9:30 horas del 11 de febrero del 2022, citando su propia jurisprudencia, indicó lo siguiente:

“Sobre el derecho a la salud y a un ambiente sano y ecológicamente equilibrado. Debe indicarse, en primer lugar, que los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Constitución Política), así como a través de la normativa internacional aplicable en Costa Rica. En este sentido, en sentencia n.° 2006-5928 de las 15:00 horas del 02 de mayo del 2006, este Tribunal resolvió:

“El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la República. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental. Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública.

En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de “ calidad ambiental” como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras – principio de desarrollo sostenible– .” Asimismo, del artículo 50 de la Constitución Política se deriva la obligación del Estado de proteger el ambiente. Norma que establece al efecto:

"El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes".

Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado”.

VI.Caso concreto. De conformidad con los informes bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción, se comprueba que la recurrente habita una vivienda ubicada en La Colonia de Pococí de Guápiles. En el lugar no existe alcantarillado pluvial de manera que las aguas discurren formando una zanja que atraviesa varias propiedades entre ellas la de la recurrente que se encuentra en un fundo inferior. En el año 2020, la recurrente denunció ante el Ministerio de Salud la ausencia de alcantarillado pluvial y que los vecinos del lugar aprovechan la corriente para verter aguas residuales. El 20 de agosto del 2022, denunció ante la Municipalidad de Pococí que varias casas de habitación vertían aguas residuales en la corriente de aguas pluviales. El 28 de enero del 2021, el Área Rectora de Salud de Pococí, tras verificar la ausencia de alcantarillado, puso en conocimiento de la Municipalidad de Pococí lo denunciado.

El 23 de mayo del 2022, la recurrente de nuevo expuso la situación ante la Municipalidad de Pococí. En el año 2022, sin precisar fecha, la Municipalidad de Pococí respondió al Área Rectora de Salud de Pococí que el problema de aguas pluviales debe solucionarse en conjunto con el CONAVI. Además, la Municipalidad es del criterio que el problema se origina por problemas vecinales y acciones de la propia recurrente. El Área Rectora de Salud de Pococí no ha dictado ninguna orden sanitaria, pese a que ha verificado un problema de aguas residuales con olores repulsivos y arrastre de desechos. Si bien las aguas discurren por el terreno donde vive la recurrente no le ha causado daño a la casa de habitación. Por otra parte, no consta que el Área Rectora de Salud de Pococí y la Municipalidad de Pococí hubieran notificado a la recurrente el resultado de la denuncia interpuesta.

VII.De lo expuesto se deben distinguir varios aspectos. En primer término, la falta de alcantarillado pluvial. Por otra parte, el desagüe de aguas residuales. En tercer lugar, el eventual conflicto vecinal tanto por las acciones de los vecinos como de la propia recurrente. Finalmente, la omisión de las autoridades recurridas en responder a la recurrente.

VIII.En cuanto al eventual conflicto vecinal no le corresponde a esta Sala pronunciarse. Es un aspecto que se debe conocer en la vía ordinarias. No es competencia de un Tribunal Constitucional, sino del juez ordinario, conocer sobre las eventuales responsabilidades extracontractuales.

IX.En cuanto al alcantarillado pluvial, se debe aclarar lo siguiente: a esta Sala no le corresponde intervenir directamente en lo que a la gestión de obra pública se refiere. No le corresponde tomar el lugar del ente municipal y planificar el desarrollo de la infraestructura local. Ahora bien, esta Sala interviene en la medida en que la ausencia de infraestructura genere un problema de salud o bien de contaminación ambiental. En este caso, no se ha demostrado que las aguas pluviales sean las que generan tales problemas. El problema de contaminación proviene de las aguas residuales. Eventualmente podría resultar que la construcción de alcantarillado elimine la posibilidad de verter aguas residuales en la corriente de agua pluvial, pero el alcantarillado pluvial no tiene como fin recoger aguas residuales y la falta de este no autoriza el desagüe de aguas residuales en la corriente de agua pluvial.

Aunado a ello se debe advertir que la misma recurrente reconoce en el escrito de réplica que la corriente de agua si bien afecta el terreno no así la casa de habitación. No es aquí donde se debe determinar si, por tratarse de aguas pluviales, el fundo inferior debe o no soportar. Se debe agregar también que en este caso existe contención no solo sobre la infraestructura que exactamente se requiere sino también de los entes encargados de realizarla. Finamente, la municipalidad bien apunta que no cabe construir obras de infraestructura pública en propiedad privada e, incluso, alega que parte de problema se origina en acciones tomadas por la misma recurrente. La misma Municipalidad considera que se realizó una construcción sin permiso, todo lo cual no puede conocerse en la vía del amparo. En suma, no procede ordenar aquí la construcción del alcantarillado ni la indemnización que pretende la amparada. En cuanto a este punto, el recurso debe desestimarse.

X.Por el contrario, el Área Rectora de Salud de Pococí reconoce que discurren aguas residuales, pero no ha dictado ninguna orden sanitaria al respecto. Es muy claro que no le corresponde a esta Sala dictarlas directamente, pero sí conocer la omisión del ente encargado. Es cierto, que el Área Rectora de Salud de Pococí remitió la denuncia interpuesta en el año 2020 a la Municipalidad de Pococí, con el fin de que esta la conociera. Sin embargo, la responsabilidad del Ministerio de Salud no se limita simplemente al traslado de una denuncia, sino a conocer lo planteado y, en lo atinente a sus competencias, dictar las órdenes pertinentes contra quien, según se determine, genere el problema de contaminación. Debido a la omisión del Ministerio de Salud, se debe acoger el recurso en su contra con las consecuencias que se indican en la parte dispositiva. Se debe advertir también que no le corresponde a esta Sala revisar la pertinencia técnica de lo que eventualmente dicte el Ministerio de Salud.

XI.Finalmente, en lo que a la falta de respuesta se refiere, se trata de una cuestión que sí conoce este Tribunal, pues como se explicó al inicio, se trata de una denuncia sobre contaminación y, además, relacionada con un posible impacto en la salud. Sobre este punto, no consta que Municipalidad y el Área Rectora de Salud de Pococí hubieran contestado. Si bien el Ministerio de Salud hace referencia al carácter confidencial de la denuncia, esta no es anónima. Ambas instituciones tienen el deber de dar una respuesta aunque no le concedan a la recurrente lo que pide. Es decir, si las autoridades consideran que la denuncia es improcedente, así deben indicárselo al denunciante. No consta que lo hubiera hecho. En consecuencia, sobre este punto también debe estimarse el recurso.

XII. NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA

He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia.

Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

XIII.Voto salvado parcial respecto a la parte dispositiva de esta sentencia de la Magistrada Garro Vargas. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso que en el plazo de seis meses se verifique la contaminación por aguas residuales y se emitan las órdenes sanitarias pertinentes. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

XIV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara parcialmente con lugar el recurso únicamente por la falta de respuesta a las denuncias y la falta de intervención del Ministerio de Salud. En consecuencia, se le ordena a Karen Mayorga Quirós, Directora del Área Rectora de Salud de Pococí, o quien ocupe ese cargo, que realice las gestiones necesarias para que, en el plazo de seis meses contado a partir de la notificación de esta sentencia, se verifique la contaminación por aguas residuales y se emitan las órdenes sanitarias pertinentes. De igual forma, se le ordena a Karen Mayorga Quirós, Directora del Área Rectora de Salud de Pococí, o quien ocupe ese cargo, y a Manuel Hernández Rivera, Alcalde Municipal de Pococí, o a quien ocupe ese cargo, que, en el plazo de cinco días hábiles, contados a partir de la notificación de esta sentencia, se le brinde a la recurrente una respuesta a las denuncias interpuestas respectivamente en esa Área de Salud y en la Municipalidad.

Se advierte que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de Pococí, al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En todo lo demás, se declara sin lugar el recurso. El Magistrado Castillo Víquez pone nota. La Magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
