*CO* Case file: 22-019760-0007-CO Decision No. 2022025834 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at thirteen hours and twenty-two minutes on the twenty-eighth of October, two thousand and twenty-two.

Writ of amparo filed by Nombre01, national identification number CED01, against the MINISTERIO DE SALUD.

Whereas:

  1. 1By written submission received in the Chamber's Secretariat on September 2 of the current year, the petitioning party files a writ of amparo and states the following: that the petitioner is a resident of Santa Teresa de Cóbano and that on April 20 past, the petitioner filed a sanitary complaint (denuncia sanitaria) with the Peninsula Health Area against the Municipality of Cóbano. The petitioner notes that the complaint referenced contamination caused by garbage, on the grounds that waste collection in that locality is not being carried out adequately. However, the petitioner asserts that as of the date of filing the present amparo action, the complaint has not been resolved and the alleged problem persists. Accordingly, the petitioner considers that his fundamental rights have been violated. The petitioner requests the intervention of the Chamber.
  2. 2Nombre02, acting in the capacity of Director of the Peninsula Regional Health Authority Area (Área Rectora de Salud Peninsular), an official of the Central Pacific Regional Directorate of the Health Authority of the MINISTERIO DE SALUD, reports under oath that the complaint mentioned by the petitioner was in fact received on April 20, 2022, and was processed under case file 079-2022. From the handling of the complaint it is apparent that Nombre01. Nombre03 made an inquiry to the municipal environmental manager regarding the reported situation of problems with proper waste collection, which was recorded in minutes AI-MF-68-2022. See folios 0001 through 0009 of the case file. That in relation to the matter reported by the petitioner, written recommendations were issued to the district administrator (intendente) by email on April 20, the same day the complaints were received. These recommendations were accepted by the district administrator and responded to on that same April 20 by email.The waste collection problem was resolved the following week, as the municipal district administrator had indicated it would be in his email. In that email it was clarified that due to the activities characteristic of Holy Week, waste generation had increased by 300%. From that point in April, when the accumulated waste was collected, no further complaints or reports regarding accumulated waste in Cóbano were received until September 1, 2022. That is to say, during May, June, July, and August there was no failure in waste collection, and it was not until September that solid waste began to accumulate again in the communities of the Cóbano district. On this occasion, however, the cause of the problem was different and was not the increase in generation as had occurred during Holy Week. That on September 7, 2022, an alert was issued to the Central Pacific Regional Directorate by means of official communication MS-DRRSPC-DARSPE-389-2022, requesting assistance in analyzing the problem, since the Cóbano district has a district municipal council and a district administration that have maintained a 98% collection coverage rate across the district, demonstrating great efficiency in solid waste management since 2019.However, this emergency situation made it necessary, in the undersigned's judgment, to issue sanitary orders to the Municipality of Puntarenas, because the cause of the emergency is a lack of budget, which was disapproved on July 21, 2022. Said disapproval by the Contraloría General de La República may be reviewed on folios 0040 through 0042 of the case file. That is to say, Cóbano has collected the resources to cover waste collection and the proper operation of the district administration, but cannot access those resources because the Municipality of Puntarenas was in arrears with C.Nombre04., and this caused the disapproval of Puntarenas's budget, affecting the district administrations of the districts of Cóbano, Paquera, Lepanto, and Monteverde. In follow-up to the matter, on September 20, sanitary orders OS-DARSPE-093-2022 addressed to the Mayor of Puntarenas, OS-DARSPE-094-2022 addressed to the Puntarenas Municipal Council, and OS-DARSPE-095-2022 addressed to the district administrator of the Cóbano district were served, so that the corresponding actions could be executed to allow for timely waste collection, with a deadline of 5 business days from the date of service of those orders.Therefore, the complaint by Nombre05 regarding contamination from waste is still being processed and has not been resolved. Although the situation initially reported on April 20 was resolved and the collection service normalized for 4 months, the current situation has a different cause and origin with respect to the waste in the Cóbano district, for the reasons already set forth. What was reported in April corresponded to an accumulation stemming from the 2022 Holy Week vacation period, which stabilized in terms of collection service for 4 months. However, the current situation corresponds to a budget approval problem between Puntarenas and the Contraloría General, which affects the district administration and which could be resolved if the budget, which must be submitted before September 30, is approved, and the collection service in the district could normalize by October. This is apparent from an email dated September 14 in which the district administrator of Cóbano acknowledges the existence of a sanitary emergency, describes its cause and possible scope; a PDF copy is attached, 1 double-sided folio.
  3. 3By resolution issued at nine hours and nineteen minutes on September 27, 2022, the parties named in the writ of amparo processed under case file number 22-019760-0007-CO were deemed to have been expanded, and accordingly, notice is hereby given to the Mayor and Nombre02 of the Municipal Council, both of the Municipality of Puntarenas, and to the District Administrator of the Cóbano District Council.
  4. 4Nombre06, acting in the capacity of Nombre02 of the Puntarenas Municipal Council, reports under oath that responsibility for oversight of the Cóbano District belongs to the district administrator.
  5. 5Nombre07, in his capacity as Municipal Intendant (Intendente Municipal) of the District Council (Concejo de distrito) of Cóbano, testifies under oath that in 2010 the solid waste (residuos sólidos) situation in the District reached its highest point, as conditions worsened to such an extent that some community residents took action at the institutional level before various agencies with jurisdiction over this matter, as a result of the diverse circumstances they were facing that posed a direct threat to public health. (Among the actors involved were the Ministry of Health, the Ombudsman's Office (Defensoría de los Habitantes), the Administrative Environmental Tribunal (Tribunal Ambiental Administrativo), and even this respected Constitutional Chamber.) That situation clearly triggered a series of problems related to solid waste and its final disposal (disposición final), resulting in the issuance of an endless number of sanitary orders (ordenes sanitarias), some of which were fully or partially complied with while others were definitively not complied with, ultimately leading to the permanent closure of the dump (vertedero) on June 8, 2017.From that moment forward, they were placed in an extremely difficult situation, as they were required not only to collect and transport to the nearest authorized landfill (relleno sanitario) the solid waste existing on the streets as well as that found at the dump outside the pits, but also to transfer it to the nearest authorized landfill, which is that of the company Tecno Ambiente, located in the community of Miramar de Puntarenas, approximately 420 kilometers from Cóbano — the site where they are currently disposing of their solid waste on a daily basis, from that moment to the present, for the corresponding treatment — or alternatively to the recently opened landfill owned by the Municipality of Santa Cruz, which is offering a better price per ton of waste treated, and where they will soon be depositing waste as well. He adds that this circumstance represents a significant economic burden in carrying out these actions, both for this Municipal District Council and, by extension, for their taxpayers.He further states that, now turning properly to the matter of the complaint filed by the Petitioner (Recurrente) before the Governing Health Authority (Ente Rector de Salud), said complaint dates from the month of April of the current year, precisely during a period that can be classified as high season (temporada alta), namely Holy Week (semana mayor), during which the influx of domestic and foreign visitors to the District increases exponentially to such a degree that cabins, hotels, and vacation homes are filled entirely to capacity, which obviously generates a much greater increase in solid waste than what is normally collected on a weekly basis. This situation is always anticipated when planning at the institutional level so as to implement an action plan that includes changes to collection days and schedules in certain communities, as well as the support of services from a contractor with which this Municipal District Council holds a contract, and the rental of an additional collection truck to provide further support.Accordingly, beginning the weekend before Holy Week, the action plan prepared by the environmental management department of this Council was already being implemented. However, precisely at the peak of Holy Week — that is, on Thursday, April 7 of the current year — two of the collection units (one new unit and one from the private service) unfortunately suffered mechanical breakdowns that resulted in the complete stoppage of those units. This constituted a force majeure event (hecho de fuerza mayor) that meant the service had to continue to be provided with fewer collection trucks than planned, which evidently caused a backlog in service and consequently the accumulation of waste on some routes, since in such situations they do not have the support of the Municipality of Puntarenas. In light of the foregoing, it should be noted that despite this misfortune suffered by the municipal administration, it redoubled efforts within the limits of what was humanly possible with the resources available, given that one of their units was definitively out of service, while one of the two units from the support service rejoined operations so that the three remaining units could together normalize the total collection of solid waste and thereby avoid a direct threat to public health that could lead to the spread of disease and the proliferation of disease vectors.That situation was duly and fully remedied in the shortest possible time, thanks to the efforts of the sanitation department team, always following the recommendations and suggestions provided by the Ministry of Public Health and its professionals in that field, in order to eradicate said conditions. On another note, it should be mentioned that once the foregoing problem was resolved, the service continued to be provided normally for several months, but unfortunately, due to budgetary issues, in September of the current year they once again faced a new sanitary crisis due to a lack of financial resources to continue providing solid waste collection and transport services normally, resulting from the failure to obtain approval of the financial resources by the Office of the Comptroller General of the Republic (Contraloría General de la República). In this regard, this Municipal District Council has been experiencing negative impacts in this area since the disapproval of the 2022 Ordinary Budget (Presupuesto Ordinario 2022), which forced them to work with a reduced ordinary budget, making it impossible to increase the municipal solid waste collection service crew, to obtain additional resources to meet the need for preventive and corrective maintenance of the municipal collection vehicles, to purchase fuel and other supplies, and to secure resources to cover the cost of the contracted company's solid waste collection and transport services.However, due to the significant percentage of uncollectible debt resulting from the economic impact of Covid-19 beginning in the second quarter of 2020, both in the commercial sector and in the general income of taxpayers, there has been a significant reduction in these budgetary items. He adds that this trend has also caused a dramatic increase in the generation of ordinary solid waste and, consequently, a greater demand for the municipal collection service, resulting in the expected weekly average number of trips to be requested from the contracted company in 2022 being 4 to 5; however, due to this trend, the current weekly average is 5 to 6 trips, and in some cases even 7 or 8. This situation has created a dependency on extraordinary budgets (presupuestos extraordinarios) to meet financial requirements and/or on budgetary amendments; nonetheless, Extraordinary Budget No. 01-2022 (Presupuesto Extraordinario 01-2022) was not approved by the Office of the Comptroller General of the Republic in July of the current year.As is apparent from the existing evidence in the case file itself, the Municipality of Puntarenas was not current with its employer-employee obligations to the Costa Rican Social Security Fund (Caja Costarricense de Seguro Social), which constitutes a failure to comply with applicable regulations, and this caused the disapproval of the Municipal District of Cóbano de Puntarenas's Extraordinary Budget No. 01-2022 of the Municipality of Puntarenas — which encompasses the budget of the latter as well as those of the other Municipal District Councils — thereby making the resources earmarked to meet the requirements of the municipal solid waste collection service unavailable from that point forward. For this reason, this administration undertook the preparation of a second Extraordinary Budget No. 02-2022 (Presupuesto Extraordinario 02-2022), which has now been approved both by the members of this Municipal District Council and by the Municipal Council of Puntarenas, and which has been in the hands of the respective analysts at the Office of the Comptroller General of the Republic since October 3 of the current year, for the purpose of obtaining the long-awaited approval from that supervisory body.Nevertheless, there is no certainty as to when those budgetary resources will become available, while in the meantime the increase in demand does not abate and the collection trucks have already experienced greater wear and tear due to their more frequent use, which has evidently resulted in a higher demand for tires, fuel, lubricants, and other supplies, causing an accelerated consumption of available budgetary resources. Finally, he notes that despite this very bleak outlook, they have the assistance of friendly hands who have helped to alleviate the provision of the service and who chose to collaborate with this municipal administration — both public and private entities — who decided to join this titanic effort on behalf of the residents of the District, public health, and the environment, as the company providing this service made the decision to donate its services for eight weeks for a number of trips.Additionally, they have the support of the Municipality of San Ramón, which, in view of the situation, lent them a collection unit for one month under a cooperation agreement to address the backlog that remains to date, and which, if that regularity continues without any unforeseen events, should bring the present emergency to a close and allow them to comply with the sanitary order that was issued to them.
  6. 6Nombre08, in her capacity as Acting Municipal Mayor (Alcaldesa Municipal a.i.) of the Central Canton of Puntarenas, testifies under oath that, in fact, official communication DFOE-LOC-1214 dated July 21, 2022, from the Operational and Evaluative Oversight Division, Local Development Oversight Area of the Office of the Comptroller General of the Republic, disapproved Extraordinary Budget No. 01-2022 of the Municipality of Puntarenas, stating that the reason for such disapproval was that the Municipality of Puntarenas was in arrears with the Costa Rican Social Security Fund. While this was indeed stated in the aforementioned document, the truth is that the Municipality of Puntarenas was NEVER in arrears with the Costa Rican Social Security Fund; contrary to what the Office of the Comptroller General of the Republic indicated, this situation arose because the C.Nombre04 information system was outdated at the time the Comptroller's Office was reviewing Extraordinary Budget No. 01-2022.In that regard, the Municipal Administration has never failed to respond personally to Mr. Nombre09 — that is, his right to prompt and timely information was never infringed upon — given that the protected party (amparado) never personally and directly requested information from the Administration; rather, it was the Municipal Council that requested the information by means of a municipal resolution, to such an extent that the protected party's email address only became known at the time the Writ of Amparo (Recurso de Amparo) against this represented party was filed. Moreover, the protected party does not request that the writ be granted in favor of the Municipal Council of Puntarenas; instead, he makes it appear as though he was the one who requested the information from the outset, when in fact it was done by means of a municipal resolution, which is the form of expression of the Council, and through that vehicle he makes the request his own.Therefore, in the view of this representation, no harm whatsoever has been caused to the protected party, since no information is owed to him in a personal capacity, and the Municipal Council is already duly informed regarding what was requested.
  7. 7By ruling issued at eleven hours and eleven minutes on the twenty-sixth of October, two thousand and twenty-two, the following was requested as evidence for a better resolution of the case: that Nombre02, or whoever holds the position of Director of the Peninsular Regional Health Authority (Área Rectora de Salud Peninsular), report on the level of compliance with sanitary orders OS-DARSPE-093-2022 addressed to the mayor of Puntarenas, OS-DARSPE-094-2022 addressed to the Municipal Council of Puntarenas, and OS-DARSPE-095-2022 addressed to the municipal district intendant of Cóbano.
  8. 8Nombre02, in his capacity as Director of the Peninsular Regional Health Authority, responds to the hearing granted and states that the public health emergency situation related to waste collection in Cóbano, Puntarenas, has for now returned to normal. They are temporarily closing the complaint filed by this petitioner, as well as other complaints related to waste management in that district. However, the Regional Health Authority will continue monitoring the situation, pending approval by the Contraloría General de La República of the budget submitted by the municipality of Puntarenas and the associated intendancies, so that a stable, long-term solution may be achieved.
  9. 9The legal requirements have been observed in the proceedings conducted.

Considering:

I.Subject matter of the appeal. The petitioner claims to be a resident of Santa Teresa de Cóbano and states that on April 20 he filed a sanitary complaint (denuncia sanitaria) with the Peninsular Health Authority against the Municipality of Cóbano. He states that in the complaint he referenced contamination from garbage, given that waste collection in that locality is not being carried out properly. However, he asserts that as of the date he filed this constitutional appeal (amparo), his complaint has not been resolved and the alleged problem persists.

II.Proven facts. The following facts are considered duly established as relevant to the decision in this matter: a) the petitioner filed a complaint with the Peninsular Regional Health Authority on April 20, 2022 (evidence submitted); b) that complaint was processed under file number 079-2022, and in connection therewith, Engineer Nombre03 directed an inquiry to the municipal environmental manager regarding the reported problems with adequate waste collection, which she recorded in memorandum AI-MF-68-2022 (report submitted under oath); c) in relation to the matters reported, the respondent Regional Health Authority issued written recommendations to the district intendant by email on April 20, the same day the complaints were received, and those recommendations were accepted by the intendant and responded to that same April 20 by email, with the waste collection problem being resolved the following week (report submitted under oath); d) from that point in April when the accumulated waste was collected, no further complaints or reports of accumulated waste in Cóbano were received by the Peninsular Health Authority until September 1, 2022 (report submitted under oath); e) during May, June, July, and August, waste collection services were not disrupted, and it was not until September that solid waste again began accumulating in the communities of the Cóbano district (report submitted under oath); f) the cause of the solid waste accumulation in September of the current year is unrelated to the problem reported in April of the current year (report submitted under oath); g) in connection with the garbage problem that arose in September of the current year, on September 7, 2022, an alert was issued to the Dirección Regional Pacífico Central by means of official communication MS-DRRSPC-DARSPE-389-2022, along with sanitary orders for the Municipality of Puntarenas, because the cause of the emergency is a lack of budget, which was disapproved on July 21, 2022 (report submitted under oath); h) in follow-up to the solid waste accumulation that arose in September of the current year, sanitary order OS-DARSPE-093-2022 addressed to the mayor of Puntarenas, OS-DARSPE-094-2022 addressed to the Municipal Council of Puntarenas, and OS-DARSPE-095-2022 addressed to the municipal district intendant of Cóbano were served, so that the corresponding actions may be carried out to allow for timely waste collection (report submitted under oath).

III. Unproven facts: a) that the health authorities had responded to the complaint filed by the petitioner on April 20, 2022

IV.On the specific case.- From the analysis of the report submitted under oath and the evidence provided for resolution of this matter, this Court concludes that the petitioner's claim is without merit. The petitioner alleges that on April 20 he filed a sanitary complaint with the Peninsular Health Authority against the Municipality of Cóbano, and that despite the passage of several months the reported problem persists. In this regard, both the health authorities and the Municipal District Intendant of the Cóbano district council affirm that the situation reported by the petitioner — waste accumulation as of April 20 — was resolved. Indeed, it is stated under oath that what was reported in April corresponded to an accumulation arising from the Easter Holy Week vacation period of 2022, compounded by the breakdown of two of the collection vehicles (one new and one from a private service), which constituted a force majeure event that meant the service had to continue operating with fewer collection trucks than planned.

In addition, the respondent health authority affirms that from that point in April when the accumulated waste was collected, no further complaints or reports of accumulated waste in Cóbano were received until September 1, 2022. Nevertheless, the municipal district intendant acknowledged under oath that the waste collection problem recurred. In that regard, this Court finds that the problem reported in the present case is not an isolated incident, but rather an issue that has recurred over the years, as the authorities indicate in their report; it is resolved for periods, but the problems and failures in collection reappear. In response to the situation that arose in September of the current year, the Peninsular Health Authority, on September 20 of the current year, served sanitary orders OS-DARSPE-093-2022 addressed to the mayor of Puntarenas, OS-DARSPE-094-2022 addressed to the Municipal Council of Puntarenas, and OS-DARSPE-095-2022 addressed to the municipal district intendant of Cóbano, so that the corresponding actions may be carried out to allow for timely waste collection.

Furthermore, as evidence for a better resolution, the health authorities were asked to report on the current situation, and they informed the Court that the public health emergency related to waste collection in Cóbano, Puntarenas, has for now returned to normal. And although they state that they are temporarily closing this petitioner's complaint and other complaints related to the waste issue in that district, they acknowledge that the underlying problem has not yet been resolved, and therefore they will continue monitoring the situation, pending approval by the Contraloría General de La República of the budget submitted by the municipality of Puntarenas and the associated intendancies, so that a stable, long-term solution may be achieved. Consequently, given the sensitive nature of the matter for public health — specifically, solid waste collection — it is deemed appropriate to grant the appeal and order all respondent authorities to each, within the exercise of their respective competencies and in compliance with the principle of administrative coordination among public administrations, adopt the necessary measures to find a definitive solution to the issue of solid waste collection.

Furthermore, the record does not reflect that the health authorities notified the petitioner of the actions taken in response to his complaint from April; accordingly, the appeal must also be granted with respect to this aspect.

For the foregoing reasons, the appeal is granted on grounds of injury to the right to a healthy and ecologically balanced environment due to mismanagement of solid waste collection, and on grounds of injury to the right to a timely response (derecho de pronta respuesta), with the consequences to be stated in the operative section.

V. DISSENTING OPINION OF MAGISTRATE Nombre11

With all due respect, I dissent from the majority opinion declaring the appeal well-founded, for the following reasons:

The protection of a healthy and ecologically balanced environment, within the Costa Rican legal order (Ordenamiento Jurídico Costarricense), is safeguarded not only in Article 50 of the Political Constitution, but also in a series of statutes and executive decrees (regulations) currently in force, such as the Organic Law of the Environment, Ley N° 7554 of October 4, 1995; the Biodiversity Law, Ley N° 7788 of April 30, 1998; the Wildlife Conservation Law, Ley N° 7317 of October 21, 1992; and Decreto Ejecutivo N° 31849 of May 24, 2004, the General Regulation on Environmental Impact Assessment (evaluación de impacto ambiental, EIA) Procedures, to cite only a few. This makes it necessary, in environmental matters, to distinguish between constitutional review and legality review. In this regard, the undersigned holds the view that this Court, by way of an amparo action (recurso de amparo), should only hear a case in which a violation of the right to a healthy and ecologically balanced environment is alleged if the Administration has not yet intervened, and only when the violation of that right is manifest and evident, easy to verify, of a certain significance or gravity, and directly affects a specific person or community.

Otherwise, the matter must be raised and resolved through the legality track. For this reason, the simple failure to fulfill obligations and duties legally imposed on the various public administrations in environmental matters is properly heard in the legality track — whether administrative or judicial — where non-compliance or omissions alleged can be scrutinized with far greater breadth. It must be borne in mind that the amparo proceeding is a summary, informal, simple, and expedient process, such that from the very moment the Administration intervenes in an environmental matter, in the exercise of its powers, and conducts a proceeding with the issuance of administrative acts, jurisdiction over that matter falls outside the scope of this specialized court. Therefore, the review of administrative actions carried out in connection with an environmental matter that requires, for its proper assessment, a full-cognizance proceeding (proceso de conocimiento pleno) is only possible before the ordinary courts, since the design of the amparo process is incompatible with the comparison or review of technical or legal opinions developed under applicable statutes or regulations, or with the gathering of new and additional elements of conviction needed to compare or review the findings already on record in the administrative case file.

The contrary would transform the amparo into an ordinary full-cognizance proceeding, thereby distorting its nature and rendering nugatory the purposes for which it was designed — causing it to lose its character as an instrument for the effective protection of fundamental rights. As a consequence of the foregoing, I am of the view that when a public body or organ has intervened, in various ways, or has issued administrative acts in connection with an environmental matter, its review and oversight belongs to the contentious-administrative jurisdiction (jurisdicción de lo contencioso-administrativo). It is precisely the verification of the existence of such administrative intervention that determines that the matter falls within the competence of the legality track. Accordingly, this appeal should have been rejected outright, since its subject matter is an issue that must properly be discussed, analyzed, and resolved in the legality track.

However, since that did not occur, the appropriate course is to dismiss it on the merits, without making any ruling on the substance of the question raised, as it falls to the ordinary courts — specifically, the contentious-administrative courts — to determine whether the administrative actions and conduct complained of do or do not conform, in substance, to the provisions of the statutory legal order with regard to the protection, safeguarding, and conservation of the right to a healthy and ecologically balanced environment.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

This Court must advise the petitioning party that if any paper documents, objects, or evidence backed by any additional device, or by electronic, computer, magnetic, optical, telematic, or new-technology media have been submitted, these must be retrieved from the office within 30 business days of receipt of notification of this judgment; otherwise, all such materials will be destroyed in accordance with the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Full Court (Corte Plena) in session No. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Superior Council of the Judicial Branch (Consejo Superior del Poder Judicial) in session No. 43-12 held on May 3, 2012, Article LXXXI.

Por tanto:

The appeal is granted. Nombre08, Nombre06, and Nombre07 are ordered — in their respective capacities as acting municipal mayor (alcaldesa municipal a.i.) of Puntarenas, Nombre02 of the Municipal Council (Concejo Municipal) of Puntarenas, and municipal intendant of the District Council (Concejo de Distrito) of Cóbano, or whoever may hold such positions — to comply with sanitary orders number OS-DARSPE-093-2022, OS-DARSPE-094-2022, and OS-DARSPE-095-2022, within the deadlines set by the health authorities. Nombre02 is likewise ordered, in his capacity as Director of the Peninsular Health Governing Area (Área Rectora de Salud Peninsular), to monitor compliance with the aforementioned sanitary orders and to notify, within five days, the corresponding action with respect to the sanitary complaint filed against the Municipality of Cóbano by the petitioner on April 20 of the current year. The foregoing is issued under warning that failure to comply could constitute the offense defined in Article 71 of the Law of Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), which provides that a prison sentence of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order — which that person must comply with or cause to be complied with — issued in an amparo proceeding, and fails to comply with it or to cause it to be complied with, provided the offense is not more severely punishable under another provision.

The State and the Municipality of Puntarenas are condemned to pay damages and losses caused by the acts underlying this declaration, which shall be assessed in contentious-administrative enforcement proceedings. Magistrate Nombre11 dissents and dismisses the appeal, on the grounds that it falls to the ordinary courts — specifically, the contentious-administrative courts — to determine whether the administrative actions and conduct complained of do or do not conform, in substance, to the provisions of the statutory legal order with regard to the protection, safeguarding, and conservation of the right to a healthy and ecologically balanced environment. Notice to be served.

*CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las trece horas veintidós minutos del veintiocho de octubre de dos mil veintidós.

Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra el MINISTERIO DE SALUD.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala el 2 de setiembre del año en curso, la parte recurrente interpone recurso de amparo y manifiesta lo siguiente: que es vecino de Santa Teresa de Cóbano y el pasado 20 de abril presentó ante el Área de Salud de peninsular, una denuncia sanitaria en contra de la Municipalidad de Cóbano. Menciona que en ella hizo referencia a la contaminación por basura, debido a que, la recolección de desechos en esa localidad no se realiza de forma adecuada. No obstante, afirma que a la fecha en que acude en amparo su denuncia no ha sido resuelta y el problema alegado persiste. En consecuencia, estima lesionados sus derechos fundamentales. Solicita la intervención de la Sala.
  2. 2Informa bajo juramento Nombre02, en su condición de Director del Área Rectora de Salud Peninsular, funcionario de la Dirección Regional de la Rectoría de la Salud Pacífico Central del Ministerio de Salud, que efectivamente se recibió la denuncia mencionada por el recurrente en fecha 20 de abril de 2022. La cual se tramitó bajo el expediente 079-2022. De la atención de la denuncia se desprende que, la Nombre01. Nombre03 realizó una consulta a Gestor ambiental municipal por la situación denunciada de problemas para la adecuada recolección de residuos la cual consignó en acta AI-MF-68-2022. Ver folios 0001 al 0009 del expediente. Que en relación con lo denunciado, de parte del recurrente, se emitieron recomendaciones por escrito al señor intendente mediante correo electrónico de fecha 20 de abril, el mismo día de recepción de las denuncias. Y estas recomendaciones fueron acogidas por el intendente, y respondidas el mismo día 20 de abril mediante correo electrónico.Que el problema de recolección de residuos se resolvió la semana siguiente como lo indicó que se haría por parte del Intendente municipal en correo electrónico. En el cual se aclaró que por las actividades propias de semana santa, la generación de residuos aumentó en un 300%. Desde ese momento en abril que se recogieron los residuos acumulados, no se volvieron a recibir quejas o denuncias por residuos acumulados en Cóbano hasta el 1° de setiembre de 2022. Es decir, que en mayo, junio, julio y agosto, no se incumplió con la recolección de residuos y fue hasta setiembre, que se empezaron a acumular nuevamente residuos sólidos en las comunidades del distrito de Cóbano. Aunque en esta ocasión, la causa del problema fue otra, y no el aumento en la generación como sí sucedió en semana santa. Que en fecha 7 de setiembre de 2022, se emitió una alerta a la Dirección Regional Pacífico Central, mediante oficio MS-DRRSPC-DARSPE-389-2022.Para solicitar ayuda en el análisis del problema, ya que el distrito de Cóbano posee un concejo municipal de distrito y una intendencia que, han tenido una cobertura de recolección del 98% de su distrito, mostrando gran eficiencia en el manejo de residuos sólidos desde 2019. Pero esta situación de emergencia hacía necesaria la emisión de órdenes sanitarias para la Municipalidad de Puntarenas, a criterio del suscrito, porque la causa de la emergencia, es la carencia de presupuesto, el cual se improbó en fecha 21 de julio de 2022. Dicha improbación por parte de La Contraloría General de La República, se puede revisar en folios 0040 al 0042 del expediente del caso. Es decir, que Cóbano ha recaudado los recursos para hacer frente a la recolección de residuos y para la correcta operación de la intendencia, pero no puede acceder a dichos recursos, porque la Municipalidad de Puntarenas se encontraba morosa ante la C.Nombre04., y esto provocó la improbación de presupuesto de Puntarenas, afectando a las intendencias de los distritos de Cóbano, Paquera, Lepanto y Monteverde.Que en seguimiento al tema, el día 20 de setiembre, se notificaron las órdenes sanitarias OS-DARSPE-093-2022 dirigida al alcalde de Puntarenas, OS-DARSPE-094- 2022 dirigida al Concejo Municipal de Puntarenas, y OS-DARSPE-095-2022 dirigida al Intendente municipal de distrito de Cóbano. Para que se ejecuten las acciones correspondientes que permitan la recolección de residuos de manera oportuna. Con un plazo de 5 días hábiles a partir de dichas notificaciones. De modo que la denuncia de Nombre05 respecto a la contaminación por residuos se encuentra en trámite, y no se ha resuelto. Aunque la situación que denunció inicialmente en fecha 20 de abril, se resolvió y se normalizó por 4 meses el servicio de recolección, la situación actual tiene una causa u origen distinto con respecto a los residuos de distrito de Cóbano, por las razones ya expuestas. Ya que lo denunciado en abril, correspondía a una acumulación derivada de las vacaciones de semana santa de 2022, que se estabilizó en el servicio de recolección por 4 meses.Pero la situación actual corresponde a un problema de aprobación de presupuesto entre Puntarenas y la Contraloría General, que afecta a la intendencia, y que podría resolverse, si se aprueba el presupuesto que se debe presentar antes del 30 de setiembre, y que para el mes de octubre, podría normalizarse el servicio de recolección en dicho distrito. Así se desprende de correo electrónico de fecha 14 de setiembre en que el Intendente Municipal de Cóbano acepta la existencia de una emergencia sanitaria, describe la causa y los posibles alcances, se adjunta copia PDF, 1 folio por ambos lados.
  3. 3Mediante resolución de las nueve horas diecinueve minutos del 27 de setiembre de 2022, se tuvo por ampliadas las partes consignadas en el recurso de amparo que se tramita bajo expediente número 22-019760-0007-CO y en consecuencia, désele audiencia al Alcalde y Nombre02 del Concejo Municipal, ambos de la Municipalidad de Puntarenas y Intendente del Concejo de Distrio de Cóbano.
  4. 4Informa bajo juramento Nombre06, en su condición de Nombre02 del Concejo Municipal de Puntarenas, que la responsabilidad de la vigilancia del Distrito de Cóbano le corresponde al Intendente.
  5. 5Informa bajo juramento Nombre07, en su condición de Intendente Municipal del Concejo de distrito de Cóbano, que en el año 2010 la situación de residuos sólidos en Distrito llega a la cúspide más alta, ya que se agrava la situación a tal punto que algunos vecinos de la comunidad emprenden acciones a nivel institucional ante diversas instituciones con injerencia en este tema, producto de los diversos hechos a los que se estaban enfrenado y que comprometía una afectación directa en el tema de salud pública. (entre los cuales nos encontramos como actores como el Ministerio de Salud, Defensoría de los Habitantes, Tribunal Ambiental Administrativo y hasta esta respetable Sala Constitucional). Escenario que claramente desencadenó una serie de problemas en tema de residuos sólidos y su disposición final, generando la emisión de un sin fin de ordenes sanitarias provocando en algunas cumplimientos totales o parciales y otros incumplimientos definitivos, los cuales llevaron la clausura definitiva del vertedero en fecha 08 de Junio del 2017; lo cual desde ese momento los pone una situación extremadamente difícil, ya que los obliga no solo a recolectar y trasladarla a un relleno sanitario autorizado más cercano, los residuos sólidos existente en las calles como los existente en vertedero fuera de las fosas y efectuar su traslado a relleno sanitario autorizado más cercano, que es el de la empresa Tecno Ambiente localizado en la comunidad de Miramar de Puntarenas a unos 420 kilómetros de Cóbano, que lugar donde actualmente estamos disponiendo nuestro residuos sólidos diariamente, desde ese momento a la fecha, para el tratamiento respectivo, o en su lugar al reciente relleno sanitario propiedad de la Municipalidad de Santa Cruz, quienes está ofreciendo un mejor precio por concepto de tarifa por tonelada tratada y se estará próximamente depositando en dicho sitio.Agrega que esa circunstancia significa una gran carga económica para la ejecución de dichas acciones, tanto para este Concejo Municipal y por ende para nuestros contribuyentes. Ahora, menciona que entrando ya propiamente al tema de la denuncia planteada por el Recurrente ante el Ente Rector de Salud, tiene que la misma data del mes de abril del año en curso, precisamente en un periodo del año que lo podemos clasificar como temporada alta como es la “semana mayor”, en donde la afluencia de visitante nacionales y extranjeros al Distrito aumentan exponencialmente a tal punto que las cabinas, hotel y casas de vacacional llenan en totalidad de la capacidad de disponibilidad, lo que obviamente genera que el aumento de residuos mucho mayor de los que normalmente se viene recolectando semanalmente, situación que siempre es prevista a la hora de planificar a nivel institucional a fin de ejercer un plan de acción que involucra variaciones de los días y horarios en algunas comunidades, así como también se contempla el apoyo de los servicios de parte de contratista que posee contrato este Concejo Municipal, así como el alquiler de un camión recolector a fin de que nos brinde el apoyo, por lo que desde el fin de semana antes de la entrada de la semana santa se venía implementado el plan de acción planificado por el departamento de gestión ambiental de este Concejo.Sin embargo, precisamente empezando el pico más alto de la Semana Santa, sea precisamente el día jueves 7 de abril del año, lamentablemente dos de la unidades recolectoras (una nueva y otra del servicio privado) sufrieron desperfectos mecánicos que conllevan la paralización total de la unidades, lo que implicó un hecho de fuerza mayor, que generó que el servicio se tuvieran que continuar brindando con menos camiones recolectores de los planificados, lo que evidentemente generó un rezago en el servicio y por ende la acumulación de residuos en algunas de las rutas, ya que ante estas situaciones no cuentan con el apoyo de la Municipalidad de Puntarenas. De conformidad con lo anterior, cabe mencionar que a pesar ese infortunio sufrido la administración municipal, redobló esfuerzos dentro de lo humanamente posible con lo que se tenía, ya que definitivamente una de nuestras unidades estaba fuera de circulación, y una de las dos unidades del servicio de apoyo, se incorpora a las labores a fin de lograr normalizar entre las tres unidades la recolección de los residuos sólidos en su totalidad a fin de evitar una afectación directa a la salud pública, lo cual nos podría llevar a la propagación de enfermedades y la proliferación de vectores.Situación que fue debidamente subsanada en su totalidad y en el menor tiempo, gracias a los esfuerzos de nuestro equipo de trabajo del departamento de sanidad; ello claro está siempre atendiendo las recomendaciones y sugerencias dadas por el Ministerio de Salud Pública y sus profesionales en esa rama, a fin de erradicar dicho escenario. Por otro lado cabe mencionar una vez solventada la problemática anterior, dicho servicio se continuó brindado con normalidad por varios meses, pero lamentablemente por temas presupuestarios es que nuevamente en el mes de setiembre del año en curso, nos enfrentamos a una nueva crisis sanitaria a falta de recursos económicos que nos permitan continuar brindando con normalidad los servicios de recolección y transportes de residuos sólidos, a falta de la aprobación de los recursos económicos por parte de la Contraloría General de la República; al respecto nuestro Concejo Municipal viene sufriendo afectaciones en este sentido desde que se da la improbación del Presupuesto Ordinario 2022, lo que género que se tuviera que trabajar con presupuesto ordinario ajustado, lo que se imposibilito poder lograr incrementar la cuadrilla del servicio municipal de recolección de residuos sólidos, así como más recursos para satisfacer la necesidad de mantenimientos preventivos y correctivos de los vehículos recolectores municipales, compra de combustible y otros insumos, así como también contar con los recursos para hacerle frente a la contratación de los servicios de la empresa contratada para la recolección y transporte de los residuos sólidos.Sin embargo, a causa del importante porcentaje de incobrabilidad debido al impacto económico que causó el Covid-19 a partir del segundo trimestre del año 2020, tanto en el sector comercial, como en los ingresos de los contribuyentes en general representa una disminución significativa para estos rubros a nivel presupuestaria. Agrega que dicha tendencia también ha ocasionado un dramático crecimiento en la generación de residuos sólidos ordinarios y, por ende, una mayor demanda del servicio municipal de recolección de residuos, resultando en que, para el año 2022 la media semanal esperada de viajes a solicitar a la empresa contratada era de 4 a 5, sin embargo, debido a dicha tendencia, la media semanal actual es de 5 a 6 viajes, inclusive 7 u 8 en algunos casos. Situación que nos ha generado una dependencia de los presupuestos extraordinarios para satisfacer los requerimientos económicos, y/o de modificaciones presupuestarias, no obstante, el Presupuesto Extraordinario 01-2022 no fue aprobado por la Contraloría General de la República, en el mes de julio del año en curso.Tal y como se desprende la prueba existente en los propios autos, por cuanto la Municipalidad de Puntarenas no se mantiene al día sus obligaciones obrero patronales con la Caja Costarricense de Seguro Social, el cual corresponde un incumpliendo de la normativa vigente, que generó la Municipal de Distrito de Cóbano de Puntarenas improbación del presupuesto extraordinario 01-2022 de la Municipal de Puntarenas, que incluye el que representa y el de los demás Concejos Municipales de Distrito, lo que imposibilitó desde ese momento la disponibilidad de los recursos previstos para satisfacer los requerimientos del servicio municipal de recolección de residuos sólidos; motivo por el cual esta administración corre con efectuar la elaboración de un segundo Presupuesto Extraordinario 02-2022, el cual actualmente ya se encuentra aprobado por tanto por los señores miembros de este Concejo Municipal y del Concejo Municipal de Puntarenas, el cual desde el día 3 de Octubre del año en curso, se encuentra en poder de los respectivos analistas de la Contraloría General de la República, a fin de obtener la anhelada aprobación de parte de este ente Contralor, sin embargo no se tiene certeza en cuando se podrá disponer de los recursos presupuestarios, mientras tanto el incremente de la demanda no cesa y ya nuestros camiones recolectores ha sufrido un mayor desgaste en razón de su empleo con mayor frecuencia lo que evidentemente represento una mayor demanda en el uso de llantas, combustibles, lubricantes y otros insumos ocasionando un consumo acelerado de los recursos presupuestarios disponibles.Finalmente menciona que pese a este panorama tan negativo cuenta con la ayuda de manos amigas que nos están ayudo paliar la prestación del servicio y que quisieron colaborar con esta administración municipal, tanto pública como privada quienes decidieron unirse a esta causa titánica en favor de los habitantes del Distrito, la salud pública y el medio ambiente, ya que la empresa que brinda este servicio tomo la decisión de donar sus servicios por ocho semanas de algunos viajes. Además, cuentan con el apoyo de la Municipalidad de San Ramón, quien en vista de la situación mediante un convenio de cooperación nos prestó una unidad recolectora por un mes, para cubrir el rezago que se mantiene a la fecha y que de continuar con esa regularidad, y sin ningún imprevisto se estaría poniendo punto final a la presente emergencia, y estaríamos cumpliendo con la orden sanitaria que les fue emitida.
  6. 6Informa bajo juramento Nombre08, en su condición de Alcaldesa Municipal a.i. del Cantón Central de Puntarenas, que efectivamente en el oficio DFOE-LOC-1214 de fecha 21 de julio de 2022 de la División de Fiscalización Operativa y Evaluativa, Área de Fiscalización para el Desarrollo Local de la Contraloría General de la República improbó el Presupuesto Extraordinario No. 01-2022 de la Municipalidad de Puntarenas, indicando que el motivo de tal improbación se debía por encontrarse la Municipalidad de Puntarenas morosa con la Caja Costarricense del Seguro Social. Ello si bien es cierto se indicó en el documento supra indicado es lo cierto que la Municipalidad de Puntarenas, NUNCA estuvo morosa con la Caja Costarricense del Seguro Social, en contrario a lo indicado por la Contraloría General de la República, ello se debió a que el sistema de la C.Nombre04 para el momento de estudio de la Contraloría del Presupuesto Extraordinario 01-2022, se encontraba desactualizado el sistema de información.En ese sentido, la Administración Municipal en ningún momento le ha dejado de contestar en forma personal al señor Nombre09, es decir en ningún momento se le lesionó el derecho de información pronta y oportuna, puesto que el amparado nunca solicitó a la Administración información en forma personal y directa, sino más bien el Concejo Municipal fue quien solicitó la información mediante acuerdo municipal, tan es así que el correo electrónico del amparado se conoció hasta el momento que se conoce el Recurso de Amparo contra mí representada. Y en ese orden, el amparado tampoco solicita se acoja el recurso a favor del Concejo Municipal de Puntarenas, sino que hace ver como que quien desde un inició solicitó la información fue él, cuando fue por medio de un acuerdo municipal que es la forma de manifestación del Concejo, y de esa manera hace suya la petición, por lo que a consideración de esta representación, no se le ha causado perjuicio alguno al amparado, puesto que no se le debe información a título personal, y el Concejo Municipal ya se encuentra debidamente informado sobre lo solicitado .
  7. 7Por resolución de las once horas once minutos del veintiséis de octubre de dos mil veintidós. se solicitó como prueba para mejor resolver solicítese a Nombre02 o a quien ocupe el cargo de Director del Area Rectora de Salud Peninsular, que informe sobre el nivel de cumplimiento de las órdenes sanitarias OS-DARSPE-093-2022 dirigida al alcalde de Puntarenas, OS-DARSPE-094- 2022 dirigida al Concejo Municipal de Puntarenas, y OS-DARSPE-095-2022 dirigida al Intendente municipal de distrito de Cóbano.
  8. 8Nombre02, en su condición de Director del Area Rectora de Salud Peninsular, atiende audiencia conferida y manifiesta que por ahora se ha normalizado la situación de emergencia sanitaria relacionada con la recolección de residuos de Cóbano en Puntarenas. Y dan por cerrada temporalmente la denuncia de este recurrente y otras denuncias relacionadas con el tema de residuos de este distrito. Pero desde el Área Rectora de Salud mantenemos el seguimiento de la situación, a la espera de que la Contraloría General de La República, apruebe el presupuesto presentado por la municipalidad de Puntarenas y las intendencias asociadas. Para que la solución sea estable y a largo plazo.
  9. 9En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Nombre10; y,

Considerando:

I.Objeto del recurso. El recurrente reclama que es vecino de Santa Teresa de Cóbano y el pasado 20 de abril presentó ante el Área de Salud de peninsular, una denuncia sanitaria en contra de la Municipalidad de Cóbano. Menciona que en ella hizo referencia a la contaminación por basura, debido a que, la recolección de desechos en esa localidad no se realiza de forma adecuada. No obstante, afirma que a la fecha en que acude en amparo su denuncia no ha sido resuelta y el problema alegado persiste.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: a) el recurrente plantea denuncia ante la Área Rectora de Salud Peninsular en fecha 20 de abril de 2022 (prueba aportada); b) esa denuncia se tramitó bajo el expediente 079-2022, y ante ella, se consultó a la Ing. Nombre03 realizó una consulta a Gestor ambiental municipal por la situación denunciada de problemas para la adecuada recolección de residuos la cual consignó en acta AI-MF-68-2022 (informe rendido bajo juramento); c) en relación con lo denunciado, el Area Rectora de Salud recurrida, emitió recomendaciones por escrito al señor intendente mediante correo electrónico de fecha 20 de abril, el mismo día de recepción de las denuncias. Y estas recomendaciones fueron acogidas por el intendente, y respondidas el mismo día 20 de abril mediante correo electrónico, el problema de recolección de residuos se resolvió la semana siguiente (informe rendido bajo juramento); d) desde ese momento en abril que se recogieron los residuos acumulados, no se volvieron a recibir quejas o denuncias por residuos acumulados en Cóbano en el Area de Salud Peninsular hasta el 1° de setiembre de 2022 (informe rendido bajo juramento); e) en mayo, junio, julio y agosto, no se incumplió con la recolección de residuos y fue hasta setiembre, que se empezaron a acumular nuevamente residuos sólidos en las comunidades del distrito de Cóbano (informe rendido bajo juramento); f) la causa de la acumulación de residuos sólidos de setiembre del año en curso, no tiene relación con el problema denunciado en abril del año en curso (informe rendido bajo juramento); g) con ocasión al problema de basura suscitado en setiembre del año en curso, en fecha 7 de setiembre de 2022, se emitió una alerta a la Dirección Regional Pacífico Central, mediante oficio MS-DRRSPC-DARSPE-389-2022 y las órdenes sanitarias para la Municipalidad de Puntarenas, porque la causa de la emergencia, es la carencia de presupuesto, el cual se improbó en fecha 21 de julio de 2022 (informe rendido bajo juramento); h) en seguimiento al tema de la acumulación de basura suscitado en setiembre del año en curso, se notificó la orden sanitaria OS-DARSPE-093-2022 dirigida al alcalde de Puntarenas, OS-DARSPE-094- 2022 dirigida al Concejo Municipal de Puntarenas, y OS-DARSPE-095-2022 dirigida al Intendente municipal de distrito de Cóbano, para que se ejecuten las acciones correspondientes que permitan la recolección de residuos de manera oportuna (informe rendido bajo juramento).

III.Hechos no probados: a) que las autoridades de salud hubieran dado respuesta a la denuncia planteada por el recurrente 20 de abril de 2022.

IV.Sobre el caso concreto.- Del análisis del informe rendido bajo juramento y de la prueba aportada para la resolución del asunto, esta Sala concluye que no lleva razón el recurrente en su reclamo. El recurrente acusa que el pasado 20 de abril presentó ante el Área de Salud de peninsular, una denuncia sanitaria en contra de la Municipalidad de Cóbano y el pese al transcurso de varios meses el problema denunciado persiste. Al respecto tanto las autoridades de salud, como el Intendente Municipal del Concejo de distrito de Cóbano, afirman que la situación que denunció el recurrente, por acumulación de basura en fecha 20 de abril, se resolvió. Incluso bajo juramento se indica que lo denunciado en abril, correspondía a una acumulación derivada de las vacaciones de semana santa de 2022, que se unió al desperfecto de dos de las unidades recolectoras (una nueva y otra del servicio privado), lo que implicó un hecho de fuerza mayor, que generó que el servicio se tuvieran que continuar brindando con menos camiones recolectores de los planificados.

Aunado a ello, la autoridad de salud recurrida afirma que desde ese momento en abril que se recogieron los residuos acumulados, no se volvieron a recibir quejas o denuncias por residuos acumulados en Cóbano hasta el 1° de setiembre de 2022. No obstante, bajo juramento, el intendente municipal acepta que el problema con la recolección de residuos se volvió a presentar. En ese sentido, esta Sala acredita que el problema que se denuncia en el caso concreto, no es una situación aislada sino que es un tema que se ha venido presentando a lo largo de los años, como indican las autoridades en su informe y su solución se da por períodos, pero luego se vuelven a presentarse los problemas y la falta de recolección. En virtud de la circunstancia presentada en setiembre del año en curso, el Área de Salud de peninsular el día 20 de setiembre del año en curso, notificaron las órdenes sanitarias OS-DARSPE-093-2022 dirigida al alcalde de Puntarenas, OS-DARSPE-094- 2022 dirigida al Concejo Municipal de Puntarenas, y OS-DARSPE-095-2022 dirigida al Intendente municipal de distrito de Cóbano, para que se ejecuten las acciones correspondientes que permitan la recolección de residuos de manera oportuna.

Incluso como prueba para mejor resolver se solicitó a las autoridades de salud, indicaran el estado actual y al respecto informan a la Sala que por ahora se ha normalizado la situación de emergencia sanitaria relacionada con la recolección de residuos de Cóbano en Puntarenas. Y pese a que señala que dan por cerrada temporalmente la denuncia de este recurrente y otras denuncias relacionadas con el tema de residuos de este distrito, aceptan que la problemática aún no se resuelve, por lo que se mantendrán en seguimiento de la situación, a la espera de que la Contraloría General de La República, apruebe el presupuesto presentado por la municipalidad de Puntarenas y las intendencias asociadas, para que la solución sea estable y a largo plazo. En consecuencia, y tratándose de un tema tan delicado para la salud pública, como es la recolección de los residuos sólidos, se estima procedente acoger el recurso y ordenar a todas las autoridades recurridas para que cada una dentro del ejercicio de sus competencias, y en cumplimiento del principio de coordinación administrativa entre las administraciones públicas, adopten las medidas necesarias para encontrar una solución definitiva al tema de la recolección de los residuos sólidos.

Además, de los autos no se extrae que las autoridades de salud, le hubieran notificado al recurrente las acciones desplegadas en relación con su denuncia del mes de abril, en consecuencia, en cuanto a este extremo el recurso también debe ser estimado.

Por lo expuesto, se acoge el recurso por lesión al ambiente sano y ecológicamente equilibrado por un mal manejo en la recolección de los desechos sólidos y por lesión al derecho de pronta respuesta, con las consecuencias que se dirán en la parte dispositiva.

V. VOTO SALVADO DEL MAGISTRADO Nombre11

Con el debido respeto, disiento del voto de mayoría que declara con lugar el recurso, con base en las siguientes razones:

La protección a un ambiente sano y ecológicamente equilibrado, en el Ordenamiento Jurídico Costarricense, está tutelado no solo en el artículo 50, de la Constitución Política, sino también en una serie de leyes y decretos ejecutivos (reglamentos) vigentes, tales como la Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; la Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; y el Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), para citar solo algunos. Esto hace necesario, en materia ambiental, separar el control de constitucionalidad del control de legalidad. En este sentido, es criterio del suscrito que esta Sala, por vía de amparo, solo debe conocer un asunto en que se alega violación al derecho a un ambiente sano y ecológicamente equilibrado, si la Administración no ha intervenido aún y cuando la violación a ese derecho sea manifiesta y evidente, de fácil constatación, de cierta importancia o gravedad y que afecte, de forma directa, a alguna persona o comunidad en concreto.

De lo contrario, el tema debe plantearse y discutirse en la vía de legalidad. Por ello, el simple incumplimiento de obligaciones y deberes impuestos legalmente a las diversas administraciones públicas en materia ambiental es propio de ser conocido en la vía de legalidad –administrativa o jurisdiccional-, donde, con mucha mayor amplitud, podrán fiscalizarse los incumplimientos u omisiones que se acusen. Debe tenerse presente que el recurso de amparo es un proceso sumario, informal, sencillo y rápido, de manera tal, que desde el momento mismo en que la Administración interviene en un asunto ambiental, en ejercicio de sus competencias, y sustancia un procedimiento, con el dictado de actos administrativos, su conocimiento resulta ajeno al ámbito de acción de esta jurisdicción especializada. Por ello, la revisión de las actuaciones administrativas llevadas a cabo en torno a un tema ambiental que requiera, para su correcta valoración, de un proceso de conocimiento pleno, solo es posible en la jurisdicción ordinaria, toda vez que el diseño del proceso de amparo es incompatible con la contrastación o revisión de criterios técnicos o jurídicos elaborados al amparo de las normas legales o reglamentarias vigentes o con la evacuación de nuevos y mayores elementos de convicción necesarios para la contrastación o revisión de los criterios que ya consten en el expediente administrativo del caso.

Lo contrario implicaría transformar el amparo en un proceso ordinario de pleno conocimiento, con lo cual se desnaturalizaría y se tornarían nugatorios los fines para los cuales ha sido diseñado, con lo cual, perdería su condición de instrumento para la tutela eficaz de los derechos fundamentales. Como consecuencia de lo anterior, estimo que cuando un ente u órgano público ha intervenido, en diversas formas, o ha dictado actos administrativos en relación con un asunto ambiental, su conocimiento y fiscalización corresponde a la jurisdicción de lo contencioso-administrativo. Es, precisamente, la verificación de la existencia de esa intervención administrativa lo que determina que el asunto sea competencia de la vía legalidad. En consecuencia, este recurso debió haberse rechazado de plano, ya que su objeto es una cuestión propia de ser discutida, analizada y resuelta en la vía de legalidad. Empero, como no se hizo así, lo procedente es declararlo sin lugar, sin hacer pronunciamiento alguno con respecto al fondo de la cuestión planteada por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Nombre08, Nombre06 y Nombre07, por su orden alcaldesa municipal a.i. de Puntarenas, Nombre02 del Concejo Municipal de Puntarenas e intendente municipal del Concejo de Distrito de Cóbano, o a quienes ocupen tales cargos, que cumplan las órdenes sanitarias número OS-DARSPE-093-2022, OS-DARSPE-094-2022 y OS-DARSPE-095-2022, dentro de los plazos previstos por las autoridades sanitarias. Asimismo se le ordena a Nombre02, en su condición de Director del Área Rectora de Salud Peninsular, darle seguimiento al cumplimiento de las órdenes sanitarias mencionadas y notificar dentro del plazo de cinco días lo que corresponda respecto de la denuncia sanitaria en contra de la Municipalidad de Cóbano planteada por el recurrente el 20 de abril del año en curso. Lo anterior, bajo apercibimiento de que podrían incurrir en el delito tipificado en el artículo 71 de la Ley de la Jurisdicción Constitucional, el cual dispone que se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena al Estado y a la Municipalidad de Puntarenas, al pago de daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Nombre11 salva el voto y declara sin lugar el recurso, por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado. Notifíquese.
