Writ of amparo filed by [Nombre01 001], national identity card number [CED01], President of [Nombre01 002], legal entity identification number [CED02], against the Ministerio de Obras Públicas y Transportes (MOPT) and against the Ministry of Health.
WHEREAS:
"Our petition in light of this situation is that the writ of amparo be granted and that, on an urgent basis:
1- A routine maintenance plan for the parcels be implemented.
2- Perimeter fencing of the parcels be installed to prevent vehicles from entering, to be resolved as deemed best by MOPT, in order to prevent vehicles from parking there as well as the noise pollution they cause to neighboring residents.
3- A management plan for the parcels be established to prevent these situations in the future.
As determined within the scope of the honorable justices with respect to this case."
"1.- By document dated December 18, 2018, Engineer [Nombre01 001], President of the Asociación de Desarrollo de Río Segundo de Alajuela (ADI), requested that MOPT clear the lots that are the subject of the present Writ of Amparo.

The Road Inspection and Demolitions Department has at all times acted in accordance with the law in this matter, and has even carried out periodic clearing of the lots that are the subject of the present Recurso de Amparo, jointly and with the support of the Public Works Division and the Highway Safety and Beautification Directorate, since January 2019.
Likewise, as a result of the formation of the Commission within the Administrative Division, chaired by Mr. Christian Méndez Blanco, to address sanitary orders pertaining to State-owned lots, the present case was referred to that Commission as of April 2021, for handling through the Highway Safety and Beautification Directorate.
Furthermore, since May of the current year, the Consejo Nacional de Vialidad (CONAVI) has assumed competence over the present matter, specifically through that entity's Road and Bridge Conservation Management Office.
For this reason, both the Road Inspection and Demolitions Department and the Public Works Division have acted in strict adherence to the legal framework, in strict compliance with our duties as public officials. 2022."
"REGARDING THE FACTS AND THE MERITS:
Since the date on which the complaint filed by Mr. [Name 001], in his capacity as President of [Name01 002], came to our attention, the Public Works Division coordinated the relevant actions through its departments, specifically the Road Inspection and Demolitions Department, under the Road Design Sub-Directorate of the Engineering Directorate, together with the Highway Safety and Beautification Directorate of the Administrative Division and the Regional Directorate of Alajuela, all belonging to MOPT, in order to address the matters raised in the complaint.
Additionally, the complainant was advised to file his complaint with the CONAVI San José–San Ramón Executing Unit, since that was the body responsible for addressing and resolving those matters.
Likewise, the document received on July 13, 2022, under official letter No. ADI-RS-011-2022, signed by Mr. [Name01 001] on behalf of [Name01 002], was brought to the attention of the CONAVI San José–San Ramón Executing Unit, which in turn brought said document to the attention of CONAVI's Road and Bridge Conservation Management so that they could proceed with the clearing of the lots within the scope of their competences.
By official letter No. UAP-FSJSR-2022-08-972, dated August 25, 2022, the San José–San Ramón Project Trust informed the Executing Unit that it would request CONAVI's Road and Bridge Conservation Management to carry out the maintenance of the land forming part of the right-of-way (derecho de vía) in the Río Segundo de Alajuela sector.
And in the alternative, by official letter No. UESR-08-2022-620 (717), dated September 2, 2022, the Executing Unit notified Mr. [Name01 001], President of [Name01 002], that they would continue to follow up so that the brush-clearing (chapea) work would be considered by CONAVI's Road and Bridge Conservation Management as soon as the contracts that would allow them to address their organization's request were activated.
As a follow-up to the actions carried out by MOPT's departments (the Road Inspection and Demolitions Department, the Highway Beautification unit of the Administrative Division, and the Regional Directorate of Alajuela), and in accordance with the competences of the Public Works Division, we will conduct a site visit to the properties identified in the complaint in order to verify their current condition and coordinate any actions necessary to address what is appropriate, with a view to providing a solution to the matters raised in the complaint; we will subsequently inform the Court of the actions taken by MOPT."
"PRELIMINARY CONSIDERATIONS:
In the brief initiating the present amparo remedy (recurso de amparo), Mr. [Name01 001] states that he serves as president and legal representative of [Name01 005]; however, upon review of judicial case file No. 22-023074-0007-CO, consisting of 112 pages, it is apparent that no certificate of legal standing (personería jurídica) for the aforementioned Association has been provided — a document that, it is considered, the petitioner herein should have supplied in order to confirm that he is duly authorized to act with the powers granted by law.
The resolution issued at fifteen hours and fourteen minutes on the fourteenth of October two thousand twenty-two was notified to the Consejo Nacional de Vialidad at nine hours fifteen minutes on the twentieth of October two thousand twenty-two; accordingly, each of the facts stated therein is addressed below, in the time and manner required by law.
The aforementioned resolution states:

First, the Consejo Nacional de Vialidad will not address the facts arising directly from the Ministry of Public Works and Transportation, as those matters do not fall within this Administration's competences.
Regarding the statement made by the protected party, it is important to emphasize that the described properties are owned by the Ministry of Public Works and Transportation — as the protected party himself alleges.
It should be noted that the email addresses visible in the judicial case file are valid institutional email addresses belonging to Consejo Nacional de Vialidad officials; there is also the email address …09, which was set up for the receipt of documentation both in physical and digital form, pursuant to Directive No. DIE15-003-D dated June 9, 2015, in compliance with official letter No. ACA 01-15-0309 issued by the Board of Directors on the same date, for the purpose of handling the submission of requests, complaints, disagreements, grievances, and other documents.
It should be noted that email address …06 is an email address pertaining to CONAVI officials, and while it is indeed an official institutional email address of this institution, it is not the appropriate channel for submitting a disagreement, grievance, or complaint.

Now, according to the technical report in official letter GCSV-130-2022-3255 of October 20, 2022, issued by the Road and Bridge Conservation Management, the engineering personnel for the area highlight that the Consejo Nacional de Vialidad is responsible solely for Road Conservation (Conservación Vial) on roads and bridges, and not for the maintenance of land — the subject matter of this case — pursuant to Law No. 7798, known as the Law Creating the Consejo Nacional de Vialidad, from which the following is extracted as relevant:
(…) "In this regard, and by reason of the competences set out in Law No. 7798, Law Creating the Consejo Nacional de Vialidad (CONAVI), Road Conservation corresponds to:
'… the set of activities aimed at continuously and sustainably preserving the good condition of roads and bridges, so as to guarantee optimal service to users. Road conservation encompasses everything that does not rise to the level of new construction or substantial upgrading of existing standards. Nor does it include restoration works required as a result of emergencies, except as provided by this law as an exception. Within road conservation, the following activities may be distinguished: maintenance (routine and periodic), reinforcement, rehabilitation, and targeted improvements.' (Underlining not in the original).
Thus, it is evident that the Law governing and defining CONAVI's responsibilities refers to Road Conservation specifically on roads and bridges; consequently, the petitioner's reference to land maintenance exceeds the scope of this Conservation Management." (…)

From the same evidence submitted by the petitioner, it is apparent that this Council's official, Eng. Jorge Aurelio Córdoba Fernández, informed the protected party of CONAVI's actual competence and indicated — explicitly — to whom they should properly direct their request, that being the Public Works Division of the Ministry of Public Works and Transportation.
Along the same lines, the site engineering personnel indicate that, pursuant to item No. 10 of the explicit functions of the Engineering Directorate of the Public Works Division of MOPT, those functions include:
(…) "10. To coordinate and manage matters related to the oversight of land acquired by the State for the construction of public works; and to monitor and control all matters pertaining to the use of the rights-of-way of public roads and their remnants." Also, item No. 19, corresponding to the functions of MOPT's Regional Directorates, states that they must:
"19. Collaborate, to the extent possible, with the department responsible for the registration and control of land, in the clearing of land and movable property belonging to MOPT." (…)
In light of the foregoing, it is clear that the competent unit responsible for addressing matters of State land maintenance is the Ministry of Public Works and Transportation.
This Council may only attend to what the law authorizes it to do and will not carry out tasks that are not proper to this Administration. It is important to recall what this Council is required to do under regulatory provisions. The Law Creating the Consejo Nacional de Vialidad, in its Articles 1, 3, and 4, defines the scope of the work entrusted to this Council, which concerns the construction and conservation of the national road network (red vial nacional), as well as this Council's objectives, such that the response provided in this matter is consistent with its enabling legislation.
"ARTICLE 1.- This law governs the construction and conservation of highways, through-streets, paired roadways, and bridges of the national road network…" (…)
ARTICLE 3.- The Consejo Nacional de Vialidad is hereby created as a body with maximum administrative decentralization (desconcentración máxima), attached to the Ministry of Public Works and Transportation. The Council shall have instrumental and budgetary legal personality to administer the National Road Network Fund, as well as to enter into the contracts and loans necessary for the exercise of its functions, in accordance with this law…" ARTICLE 4.- The objectives of the Consejo Nacional de Vialidad shall be the following:
As is evidenced by the cited provisions, and by virtue of the principle of legality established in both the Political Constitution and the General Law of Public Administration (Article 11 of both bodies of law), this Council may only act in accordance with what is permitted under applicable regulations; the request made by Mr. [Name01 001] goes beyond the functions of CONAVI, since that body, as already stated, is responsible for road conservation activities, and its objectives are established by law in Article 4.
It should be noted that, according to the technical report in official letter GCTT-18-2022-0401, dated October 21, 2022, issued by the Road and Bridge Contracting Management, said report explicitly sets out the direct procurement process that — at the request of the Road and Bridge Conservation Management — was awarded for the maintenance of the National Road Network in conservation zone 1-4 of the Central Region, indicating each of the activities carried out, as follows:
(…) "With respect to conservation zone 1-4, the Road and Bridge Contracting Management, upon a contracting request from the Road and Bridge Conservation Management, processed Direct Procurement No. 2021CD-000048-0006000001, 'Brush clearing (Chapea) of the right-of-way of the National Road Network in zone 1-4 Alajuela Sur; Central Region.' The process was published on the platform of the Integrated Public Procurement System (Sistema Integrado de Compras Públicas, SICOP) on November 10, 2021. The opening of bids took place on November 22, 2021. On December 20, 2021, the work was awarded to Grupo Lauher Sociedad Anónima. Contract No. 043202230090000300 was notified on February 18, 2022, for an execution period of 180 calendar days.
Currently, the Road and Bridge Contracting Division, at the request of the Road and Bridge Conservation Division, is in the process of procuring basic maintenance services for the National Road Network in Dirección01.
Among the basic maintenance activities to be contracted on the National Routes located in Dirección02 are: manual cleaning of ditches and lined channels, cleaning of inlets, headwalls, and culverts, a right-of-way and road-asset cleaning crew, a bridge cleaning crew, tree clearing, and removal of landslides (derrumbes).
It should be noted that CONAVI, in accordance with its competencies, will carry out its interventions within the right-of-way (derecho de vía) of the National Road Network." (…)
It is worth recalling that the legislature chose to assign functions to different institutions and to allocate specific resources for carrying out those functions. Within this framework, CONAVI may only perform the tasks authorized to it under ley 7798 "Ley de Creación del Consejo Nacional de Vialidad," and, as has been indicated, CONAVI has not committed any failure that affects the petitioner.
In conclusion, it is considered that the Consejo Nacional de Vialidad has not infringed the fundamental rights of the petitioner, nor has it failed to act in addressing the problem described. It is reiterated that the competent institution is the Ministerio de Obras Públicas y Transportes."
"REPORT In order to structure our response and refute the arguments put forward by the appellant, it is appropriate in this matter to address each of those arguments specifically, setting out our legal and technical grounds.
Accordingly, we proceed below to outline our arguments of fact and law.
On the Role of the Ministerio de Obras Públicas y Transportes In the present case, on July 21, 2022, this Ministry received official memorandum No. ADIRS-2022-011, signed by Mr. [Nombre01 001], President of the Asociación de Desarrollo de Río Segundo de Alajuela, in which he reported on a problem involving a MOPT property with frontage on a national road in both Dirección03 and Dirección04, in the Río Segundo de Alajuela area.
In response to the complaint, by means of Correspondence Transfer No. DM-TC-2022-1123, dated August 10, 2022, this Ministry processed the matter accordingly and forwarded official memorandum No. ADI-RS-011-2022 to the Road Inspection and Demolitions Department for attention within that Department's legally assigned competencies.
Accordingly, Lic. Roque Campos Anchía, an official of the Road Inspection and Demolitions Department, via e-mail dated August 19, 2022, forwarded to Engineer Andrés Henao Fernández, of the San José–San Ramón Executing Unit, document No. ADI-RS-011-2022, dated July 13, 2022, signed by Mr. [Nombre01 001], President of [Nombre01 002], stating:
"For your information and for whatever action may be appropriate, please find attached official memorandum ADIRS-011-2022 dated July 13, 2022, as a follow-up to the complaint regarding the clearing of State lots in Río Segundo de Alajuela and in the vicinity of Dirección02, from the Board of Directors of [Nombre 011]." By e-mail dated August 20, 2022, Engineer Andrés Henao Fernández, of the San José–San Ramón Executing Unit, replied to Lic. Roque Campos Anchía, official of the Road Inspection and Demolitions Department, regarding document No. ADI-RS-011-2022, dated July 13, 2022, signed by Mr. [Nombre01 001], President of [Nombre01 002], stating, in the relevant part:
"(…) in accordance with what is established in the Road Conservation Transition Plan that forms part of said Transfer, responsibility for maintaining the road until the start of the construction phase of the Integral Project falls on the Road and Bridge Conservation Division of Conavi. It having been determined that, with respect to the tasks within Conavi's competency for addressing said complaint, this includes brush-clearing (chapea) of the lots that form part of the project's right-of-way, the e-mail and documentation provided by Mr. Nombre02 were forwarded to the Road and Bridge Conservation Division of Conavi, by means of official memorandum UESR-08-202-393 of June 3, 2022." (Emphasis and underlining not in the original.)
Subsequently, by official memorandum No. UESR-08-2022-590, dated August 26, 2022, Engineer Andrés Henao Fernández, of the San José–San Ramón Executing Unit, forwarded to the Road and Bridge Conservation Division updated information regarding the intervention at the properties that are the subject of the present appeal, so that the clearing of the lots could proceed within that Division's area of competency.
By official memorandum No. UAP-FSJSR-2022-08-972, dated August 25, 2022, the San José–San Ramón Project Trust (Fideicomiso) stated the following:
"In light of the foregoing, we recommend that the UESR once again request that Conavi's Road Conservation Division carry out maintenance on the properties forming part of the right-of-way in the Río Segundo de Alajuela area." (Emphasis and underlining not in the original.)
By official memorandum No. UESR-08-2022-620 (717), dated September 2, 2022, from the San José–San Ramón Project Executing Unit, addressed to Engineer [Nombre01 001], President of [Nombre01 002], the following was stated:
"In light of the foregoing, and as indicated in the e-mail of August 20, this Executing Unit will continue to follow up so that these brush-clearing tasks may be taken up by the Road Conservation Division as soon as the contracts that would enable it to address your request are activated." (Emphasis and underlining not in the original.)
It should be noted that, as indicated above, this Ministry of Public Works and Transportation has acted in compliance with the legal framework. Moreover, the Road Inspection and Demolitions Department and the Public Works Division—which, according to official memorandum No. DVOP-2022-1473 of October 24, 2022, signed by Eng. Alonso Mora Arroyo, will conduct a site visit to the properties reported in order to verify their current condition and coordinate the actions necessary to address what falls within its competency—have likewise done so.
On the e-mail communications.
The resolution of fourteen hours and fourteen minutes of October fourteenth, two thousand and twenty-two also stated: "Furthermore, the respondent authority must report whether the e-mail addresses to which the appellant sent the requests are established as an official mechanism for receiving submissions from users." On this point, it is necessary to state that submissions directed specifically to the Office of the Minister of Public Works and Transportation must be sent to the official electronic address designated to receive documentation, namely the e-mail address: ...10.
I also note that as of this date, the e-mail address ...01 does not correspond to any official of this institution."
"1.- With regard to what the petitioner has stated and the background information on record with this Health Area Governing Authority, in 2019, by means of official memorandum DVOP-DI-DV-IVD-2019-40, the Ministerio de Obras Públicas y Transportes informed the complainants that in relation to their request, maintenance work would be carried out on the referenced properties. With regard to the matters raised in points 1, 2, and 3, the undersigned is of the view that it should be officials of the Ministerio de Obras Públicas y Transportes who issue an opinion.
This authority has responded to and addressed both what was required by the Defensoría de los Habitantes and what was requested by Ms. Adriana Cordero Jiménez. The assessment and response deadlines have been respected, as have the respective competencies, and the matter has been referred to the responsible institution (MOPT) for it to address."
The opinion is drafted by Magistrate Cruz Castro; and,
Considering:
The appellant stated that the Ministerio de Obras Públicas y Transportes owns several parcels of land in Río Segundo de Alajuela, which form part of future road projects (the Radial Río Segundo Panasonic and the widening of Dirección05). Due to abandonment, these parcels have become dumping grounds for rubble and garbage and are used as a "motel" and for clandestine parties where alcohol and drugs are consumed and audio equipment is played at high volumes. Since 2018, complaints have been filed with MOPT, but the problem remains unresolved. The relief sought through this amparo action is the following:
"Our request in this situation is that the amparo appeal be granted and that, as a matter of urgency:
1- A routine maintenance plan for the properties be implemented.
2- A perimeter enclosure be erected around the properties to prevent vehicles from entering, with the best solution to be determined by MOPT, in order to prevent vehicle parking as well as the noise pollution (contaminación sónica) that these vehicles cause to neighboring residents.
3. Management plan for the parcels to prevent these situations in the future.
"In accordance with the guidance provided by the justices regarding this case."
The following facts are considered duly established as relevant to the decision in this matter:
A.- Regarding the Ministry of Public Works and Transportation and the National Road Council 1) By means of a document dated December 18, 2018, Engineer [Nombre01 001], President of the Community Development Association (Asociación de Desarrollo) of Río Segundo de Alajuela (ADI), requested that MOPT carry out the clearing of the parcels that are the subject of the present writ of amparo (recurso de amparo) (report filed).
"With instructions from the Head of the Department, and in reference to official communication No. DVA-2021-67 from the Administrative Division of this Ministry, regarding the intervention of State-owned parcels subject to sanitary orders, you are requested to determine whether it is feasible to include again the State-owned parcels located along Dirección01, in front of Dirección02, and in Río Segundo de Alajuela, which were previously intervened by that Commission.
The aforementioned State-owned parcels were the subject of complaints by the Community Development Association of Río Segundo and were subject to Sanitary Order No. CZ-00004-2019, dated February 7, 2019, from the Health Rector Area Directorate of Alajuela, Ministry of Health. (…) These are the same parcels previously intervened by the Commission that you chair, on which the weeds have grown back." (report filed).
"Good afternoon. As you indicate, at some point the Highway Safety and Beautification Directorate was asked, in collaboration with the Public Works Regional Office of Alajuela, to assist with the clearing of parcels located on Dirección01; however, Engineer [Nombre01 001], President of [Nombre01 002], was also advised to submit a request to the San José–San Ramón Executing Unit of CONAVI, as that is the body responsible for addressing and resolving these matters." (report filed).
"Regarding your complaint requesting the clearing of State-owned parcels designated for the San José–San Ramón road project, and in accordance with instructions from the Administrative Division of this Ministry, please direct your request to the San José–San Ramón Executing Unit of CONAVI, as that is the body responsible for addressing and resolving these matters. The General Manager of the San José–San Ramón Executing Unit is Engineer Pablo Camacho Salazar, and his email address is: ...08, to whom we are copying this email." (report filed).
"Dear colleague, what has been submitted is sufficient. Thank you very much for your collaboration." (submitted report).
"For your information and for whatever action may be appropriate, please find attached official letter number ADI-R5-011-2022 dated July 13, 2022, as a follow-up to the complaint regarding the clearing of State-owned lots in Río Segundo de Alajuela and in the vicinity of [Dirección02], from the Board of Directors of [Nombre01 002]." (submitted report).
"(...) in accordance with the provisions of the Road Conservation Transition Plan (Plan de Transición de la Conservación Vial) that forms part of said Transfer, responsibility for maintenance of the roadway until the start of the construction phase of the Comprehensive Project lies with CONAVI's Road and Bridge Conservation Management (Gerencia de Conservación de Vías y Puentes). Therefore, having determined that, with respect to the tasks within CONAVI's competence for addressing said complaint, the clearing (chapeo) of these lands that form part of the project's right-of-way (Derecho de Vía) is required, the matter was forwarded to CONAVI's Road and Bridge Conservation Management, along with the email and related documentation, in part through official letter UESR-08-202-393 dated June 3, 2022." (submitted report).
"In light of the foregoing, we recommend that the UESR once again request CONAVI's Road Conservation Management to carry out maintenance on the lands forming part of the right-of-way in the Río Segundo de Alajuela sector." (submitted report).
"In light of the foregoing, and as indicated in the email of August 20, this Executive Unit will continue to follow up in order to ensure that these clearing tasks are considered by the Road Conservation Management as soon as the contracts that would allow the work requested by you to be carried out are activated." (submitted report).
B.- Regarding the Regional Health Authority (Área Rectora de Salud) of Alajuela 1 31) In 2019, through official letter DVOP-DI-DV-IVD-2019-40, MOPT informed the complainants that, in relation to their request, maintenance work would be carried out on the referenced properties (submitted report).
III.On the merits. Regarding the subject matter at hand, this Chamber has ruled on multiple occasions. Recently, in judgment 2022003203 of 9:30 a.m. on February 11, 2022, citing its own jurisprudence, it stated the following:
"On the right to health and to a healthy and ecologically balanced environment. It must first be noted that the fundamental rights to health and to a healthy and ecologically balanced environment are constitutionally recognized (articles 21, 50, 73, and 89 of the Political Constitution), as well as through the international instruments applicable in Costa Rica. In this regard, in judgment n.° 2006-5928 of 3:00 p.m. on May 2, 2006, this Tribunal resolved:
"The right to life recognized in article 21 of the Constitution is the cornerstone upon which all other fundamental rights of the country's inhabitants rest. Likewise, the right to health finds its basis in that same provision of the political charter, since life is inconceivable unless minimum conditions are guaranteed to the human person for an adequate and harmonious psychic, physical, and environmental balance. Now, public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in articles 21, 50, 73, and 89 of the Political Constitution. Specifically, article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of the foregoing, this Tribunal has drawn on the notion of 'environmental quality' as a parameter, precisely, of people's quality of life, which is combined with other elements such as health, food, work, and housing, referring to the fact that every person has the right to make use of the environment for their own development, but not in an unlimited manner, since there is also a duty to protect and preserve the environment for present and future generations — the principle of sustainable development —." Likewise, from article 50 of the Political Constitution derives the State's obligation to protect the environment. That provision establishes to that effect:
"The State shall seek the greatest well-being for all inhabitants of the country, organizing and stimulating production and the most equitable distribution of wealth. Every person has the right to a healthy and ecologically balanced environment. They are therefore entitled to report acts that violate that right and to claim reparation for the resulting damage. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding responsibilities and sanctions." This confirms that the various public authorities have the inescapable duty to preserve, defend, and guarantee every person's fundamental right to health and to a healthy and ecologically balanced environment."
IV.Specific Case. First and foremost, it must be clarified that the petitioner is not seeking a formal response to the complaints filed. On the contrary, he himself states—and provides supporting documentation—that he has indeed received official communications from the respondent authorities in reply to what he brought to their attention. The relief sought through this writ of amparo (recurso de amparo) is that the underlying problem be resolved. In that regard, in accordance with the sworn reports, with the consequences—including criminal ones—provided for in Article 44 of the Law governing this Jurisdiction, it is established that the petitioner reported the situation described herein both to the MOPT and to the Ministry of Health. Indeed, originally through a document dated December 18, 2018, Engineer [Nombre01 001], President of the Río Segundo de Alajuela Development Association (ADI), requested of the MOPT, in official communication number 18-2018, a copy of which is provided, the clearing of the lots that are the subject of this writ of amparo.
As a result of the complaint, the Road Inspection and Demolitions Department (Departamento de Inspección Vial y Demoliciones) verified the problem. By message dated January 16, 2019, the Road Inspection and Demolitions Department notified Mr. [Nombre01 001] of the following: "I hereby inform you that the field inspection has already been carried out and the necessary resources are being arranged to address the matter, in order to include it in our work plan." For its part, on January 30, 2019, the Dirección Área Rectora de Salud Alajuela 1, of the Dirección Regional de Rectoría de la Salud Central Norte, of the Ministry of Health, communicated to the Road Inspection and Demolitions Department sanitary order number CZ-00004-2019. In compliance with this order, on February 1, 4, 5, 6, and 7, 2019, officials of the Road Inspection and Demolitions Department attended the aforementioned properties to carry out clearing work on said lots, with the collaboration of the Alajuela Regional Office of the Public Works Division.
Through document No. ADI-RS-002-2021, dated January 21, 2021, Engineer [Nombre01 001], President of the Río Segundo de Alajuela Development Association (ADI), again requested that the MOPT intervene with respect to the lots that are the subject of this writ of amparo. Subsequently, on May 12, 2022, at the request of the Road Inspection and Demolitions Department of the Road Design Sub-Directorate of the Engineering Directorate of the Public Works Division (and as a result of the communication made by the Río Segundo Development Association on May 11, 2022), the Road Inspection and Demolitions Department, in order to verify the current condition of the lots that are the subject of this writ of amparo and to assess a possible on-site intervention as indicated in the aforementioned official communication No. DVA-2021-146, conducted an ocular inspection of the properties, confirming the presence of overgrowth (maleza) covering 90% of the area of the repeatedly mentioned plots.
By e-mail message dated May 25, 2022, Licenciado Roque Campos Anchía, an official of the Road Inspection and Demolitions Department, communicated the following to Lic. Christian Méndez Blanco, Administrative Sub-Director: "Under instructions from the Department Head, and in connection with official communication number DVA-2021-67 from the Administrative Division of this Ministry, relating to the intervention of State-owned lots under sanitary orders; I request whether it is feasible to once again include the State-owned lots located on Dirección01, in front of Dirección02 and in Río Segundo de Alajuela, which were previously intervened by that Commission. The aforementioned State-owned lots were the subject of complaints by the Río Segundo Development Association and were covered by Sanitary Order No. CZ-00004-2019, dated February 7, 2019, from the Dirección de Área Rectora de la Salud de Alajuela of the Ministry of Health.
(…) These are the same lots intervened the previous time by the Commission you chair, in which the overgrowth has grown back." By e-mail message dated May 30, 2022, Licenciado Roque Campos Anchía, an official of the Road Inspection and Demolitions Department, communicated the following relevant information to Mr. [Nombre01 001], President of the [Nombre01 002]: "With regard to your complaint concerning the clearing of State-owned lots designated for the San José–San Ramón road project; pursuant to instructions from the Administrative Division of this Ministry, please direct the request to the San José–San Ramón Executing Unit of CONAVI, as that is the body responsible for addressing and resolving these matters. The General Manager of the San José–San Ramón Executing Unit is Engineer Pablo Camacho Salazar, and his e-mail address is: …08, to whom we are copying this e-mail." By e-mail message dated June 1, 2022, Engineer Andrés Henao Fernández, of the San José–San Ramón Executing Unit, responded to Lic. Roque Campos Anchía, an official of the Road Inspection and Demolitions Department—who had brought to his attention the complaint filed by Mr. [Nombre01 001], President of the [Nombre01 002], and forwarded the relevant documents—with the following: "Dear colleague, what has been provided is sufficient.
Thank you very much for your assistance." Through document No. ADI-RS-011-2022, dated July 13, 2022, Engineer [Nombre01 001], President of the Río Segundo de Alajuela Development Association (ADI), again requested that the MOPT (specifically the Minister of Public Works and Transport) intervene with respect to the lots that are the subject of this writ of amparo. By Correspondence Transfer No. DM-TC-2022-1123, dated August 10, 2022, the Minister's Office forwarded the aforementioned official communication ADI-R5-011-2022 to the Road Inspection and Demolitions Department of the Road Design Sub-Directorate of the Engineering Directorate of the Public Works Division, to be addressed within the Department's legally assigned competencies. Furthermore, by e-mail message dated August 19, 2022, Lic. Roque Campos Anchía, an official of the Road Inspection and Demolitions Department, forwarded to Engineer Andrés Henao Fernández of the San José–San Ramón Executing Unit document No. ADI-RS-011-2022, dated July 13, 2022, signed by Mr. [Nombre01 001], President of the [Nombre01 002], stating: "For your information and for such action as may be appropriate, please find attached official communication number ADI-R5-011-2022 dated July 13, 2022, submitted as a follow-up to the complaint regarding the clearing of State-owned lots in Río Segundo de Alajuela and in the vicinity of Dirección02, from the Board of Directors of the [Nombre01 002]." By e-mail message dated August 20, 2022, Engineer Andrés Henao Fernández of the San José–San Ramón Executing Unit responded to Lic. Roque Campos Anchía, an official of the Road Inspection and Demolitions Department, with regard to document No. ADI-R5-011-2022, dated July 13, 2022, signed by Mr. [Nombre01 001], President of the [Nombre01 002], with the following relevant information: "(…) in accordance with the provisions of the Road Conservation Transition Plan that forms part of said Transfer, it is the responsibility of CONAVI's Roads and Bridges Conservation Management Office to maintain the road until the start of the construction phase of the Integral Project.
Therefore, having determined that, with respect to the tasks falling within CONAVI's competence for addressing said complaint, the brushcutting (chapeo) of those parcels forming part of the project's right-of-way is the appropriate action, we proceeded to forward the e-mail and documentation to CONAVI's Roads and Bridges Conservation Management Office, in part through official communication UESR-08-202-393 dated June 3, 2022." By official communication No. UESR-08-2022-590, dated August 26, 2022, Engineer Andrés Henao Fernández of the San José–San Ramón Executing Unit forwarded to the Roads and Bridges Conservation Management Office updated information on the intervention of the properties that are the subject of this writ, so that the clearing of the lots could proceed within the scope of that office's competence. By official communication No. UAP-FSISR-2022-08-972, dated August 25, 2022, the San José–San Ramón Project Trust (Fideicomiso del Proyecto San José-San Ramón) stated the following: "Based on the foregoing, we recommend that the UESR once again request CONAVI's Road Conservation Management Office to carry out maintenance on the parcels forming part of the right-of-way in the Río Segundo de Alajuela sector." By official communication No. UESR-08-2022-620 (717), dated September 2, 2022, from the San José–San Ramón Project Executing Unit, addressed to Engineer [Nombre01 001], President of the [Nombre01 002], the following was stated: "In light of the foregoing and as indicated in the e-mail of August 20, this Executing Unit will continue to follow up so that these brushcutting tasks may be considered by the Road Conservation Management Office as soon as the contracts that would allow for the fulfillment of your request are activated." On the other hand, the Área Rectora de Salud de Alajuela 1 received the complaint in 2019 and, as noted, issued sanitary order CZ-00004-2019 to the Ministry of Public Works and Transport so that the Road Department could proceed with the clearing of the aforementioned parcels.
Likewise, with respect to that directive, through official communication DVOP-DI-DV-IVD-217-17, officials of the Ministry of Public Works and Transport reported compliance with the administrative act that had been issued.
From all of the foregoing, it is clearly apparent that the reported problem persists. Now, on the one hand, the Manager of the Roads and Bridges Conservation Office of the Consejo Nacional de Vialidad (CONAVI) argues that it is not CONAVI but the MOPT that is responsible for resolving the problem. On the other hand, the Head of the Road Inspection and Demolitions Department of the Road Design Sub-Directorate of the Engineering Directorate of the Public Works Division argues that it is CONAVI's responsibility to do so. In this regard, it is entirely clear that these are two bodies that ultimately form part of the Ministry of Public Works and Transport, and accordingly it is neither the user's nor this Court's role to determine which of them bears responsibility. Internal organizational arrangements fall within the Ministry's own purview. Furthermore, it is equally clear that the complaint was originally filed in December 2018.
At that time, the Road Inspection and Demolitions Department of the Road Design Sub-Directorate of the Engineering Directorate of the Public Works Division conducted inspections. The sanitary order was directed precisely at that department. It is therefore unacceptable that, at this juncture, it should simply attribute responsibility to another department or body. Likewise, it is clear that CONAVI as well—insofar as the San José–San Ramón Executing Unit explained why CONAVI must also participate in the solution—bears responsibility. In the third place, the original complaint, as noted, dates from December 2018, meaning that the Administration has had ample time to define its specific responsibilities. A lack of coordination cannot justify the failure to resolve a problem that has already been verified. Consequently, the amparo must be granted against the MOPT, including CONAVI. On the other hand, the Área Rectora de Salud de Alajuela 1 now indicates that, because the location is an open and public thoroughfare, it falls to the Ministry of Public Works as the body responsible for roadways, as well as to the Traffic Police, the Public Security Force, and the Municipal Police, to intervene. On this point, it is observed that the Health Area did originally issue a sanitary order. This is not a case in which it is simply unable to intervene at this time.
On the other hand, even though the land belongs to the State, the fact remains that, among other things, this amparo proceeding indicates that it is being used as a dumping ground for garbage, with all the attendant problems this may entail. Given the nature of the problem, which is ongoing insofar as it is largely a matter of lack of maintenance, the Ministry of Health must remain vigilant and issue whatever sanitary orders (órdenes sanitarias) may be necessary. Since it has failed to do so, the amparo must also be upheld against the Ministry of Health.
V.Partial dissenting vote with respect to the operative section of this judgment by Justice Garro Vargas. Although I agree with the majority of the Court that the petition (recurso) should be granted, I differ as to where the enforcement phase of the matter should be lodged, given the absence of adequate mechanisms provided by the rules governing this constitutional jurisdiction for monitoring a judgment that involves technically complex aspects—specifically, in this case, resolving the problem reported by the petitioner concerning a series of plots of land belonging to the Ministry of Public Works that are being used clandestinely as dumping grounds and for clandestine gatherings. By contrast, the provisions of the Code of Administrative Litigation Procedure (Código Procesal Contencioso-Administrativo) on enforcement (article 155 et seq.) offer clear advantages, such as the ability to request schedules, impose fines, establish liability, and oversee stages of compliance, among others.
For that reason, in accordance with the provisions of article 56 of the Law on Constitutional Jurisdiction (Ley de Jurisdicción Constitucional), I consider that the enforcement phase must be conducted before the Enforcement Division (Área de Ejecución) of the Administrative Litigation and Civil Treasury Court (Tribunal Contencioso Administrativo y Civil de Hacienda), under the judgment-enforcement rules of that Code.
The petitioner is hereby notified that, if any documents in paper form have been submitted, as well as objects or evidence contained in any additional device of an electronic, computer, magnetic, optical, telematic, or new-technology nature, such materials must be retrieved from the clerk's office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, all material not retrieved within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Full Court (Corte Plena) in session number 27-11 of August 22, 2011, article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Superior Council of the Judiciary (Consejo Superior del Poder Judicial) in session number 43-12 held on May 3, 2012, article LXXXI.
Por tanto:
The petition is granted. Accordingly, Carlos Arguedas Chaverri, Director of the Alajuela 1 Regional Health Authority (Área Rectora de Salud Alajuela 1), or whoever holds that position, is ordered to take the necessary steps to inspect the reported site and issue the relevant sanitary orders within one month counted from notification of this judgment. Likewise, Luis Esteban Amador Jiménez, Minister of Public Works and Transport (Ministerio de Obras Públicas y Transportes); Alonso Mora Arroyo, General Directorate of the Public Works Division (Dirección General de la División de Obras Públicas); Vinicio Barboza Ortiz, Head of the Road Inspection and Demolitions Department of the Road Design Sub-Directorate of the Engineering Directorate of the Public Works Division (Jefe del Departamento de Inspección Vial y Demoliciones de la Subdirección de Diseño Vial de la Dirección de Ingeniería de la División de Obras Públicas), all of the Ministry of Public Works and Transport; and Pablo Camacho Salazar, Road and Bridge Conservation Manager of the National Road Council (Consejo Nacional de Vialidad), or whoever holds those positions, are ordered to take the necessary steps to resolve the reported problem within one year counted from notification of this judgment.
Notice is hereby given that, pursuant to article 71 of the Law on Constitutional Jurisdiction, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order that must be complied with or enforced, issued in an amparo petition, and fails to comply with or enforce it, provided the offense is not more severely penalized under another provision. The State and the National Road Council are condemned to pay the costs, damages, and losses caused by the acts underlying this ruling, which shall be assessed in the enforcement phase of administrative litigation proceedings. Justice Garro Vargas dissents with respect to the enforcement of this judgment and, in accordance with article 56 of the Law on Constitutional Jurisdiction, provides that enforcement must be conducted before the Enforcement Division of the Administrative Litigation and Civil Treasury Court, under the enforcement rules set forth in articles 155 et seq. of the Code of Administrative Litigation Procedure. She further orders that a copy of the judgment be forwarded to that court so that enforcement proceedings may be initiated. Notify the parties.

*220230740007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinticinco de noviembre de dos mil veintidos .
Recurso de amparo interpuesto por [Nombre01 001], cédula de identidad número [CED01] , Presidente de la [Nombre01 002], cédula jurídica número [CED02], contra el Ministerio de Obras Públicas y Transportes (MOPT) y contra el Ministerio de Salud.
RESULTANDO:
“Nuestra petitoria ante esta situación es que se declare con lugar el recurso de amparo y de manera urgente:
1-Plan de mantenimiento rutinario para los terrenos.
2-Cerramiento perimetral de los terrenos para evitar el ingreso de vehículos, a mejor resolver por parte del MOPT, para evitar el estacionamiento de vehículos así como la contaminación sónica que estos ocasionan a los vecinos del lugar.
3-Plan de administración de los terrenos para evitar estas situaciones a futuro.
Según los alcances de los señores magistrados al respecto de este caso”.
“1.- Mediante el documento de fecha 18 de diciembre del 2018, el Ingeniero [Nombre01 001], Presidente de la Asociación de Desarrollo de Río Segundo de Alajuela (ADI), solicitó al MOPT la limpieza de los lotes objeto del presente Recurso de Amparo.
“En razón de todo lo anterior, y debido a que el área a intervenir es de 16637 m2 se recomiendo proceder con las labores de limpieza, para lo cual es indispensable coordinar labores con la regional de Alajuela para disponer de maquinaria adecuada que agilice los trabajos”. “Le comunico que ya se hizo la inspección de campo y se están gestionando los recursos necesarios para la atención del caso, para incluirlo en nuestro plan de trabajo.”
“Me permito informarle, que dicha limpieza se podrá realizar a partir de la próxima semana, no omito manifestar que, no contamos con un lugar para botar la maleza indicada.”
“En razón de todo lo anterior, se recomiendo proceder con cierre del caso, procurando la coordinación adecuada para un mantenimiento periódico futuro.
Es importante remitir a la dirección de Embellecimiento de Carreteras el caso de estas propiedades para estudiar la posibilidad de aplicar algún productor agroquímico que evite que la maleza crezca de forma acelerada en el sitio.” (El destacado y subrayado no pertenecen al original)
“Con instrucciones del Jefe del Departamento, y en relación con el oficio número DVA- 2021-67 de la División Administrativa de este Ministerio, para la intervención de lotes del Estado con órdenes sanitarias; se le solicita si es factible incluir los siguientes lotes del Estado ubicados sobre la Dirección01, frente al Dirección02 y en Río Segundo de Alajuela (...)
Los anteriores lotes del Estado, tienen de la Asociación de Desarrollo de Río Segundo y Orden Sanitaria No CZ-00004-2019 de fecha 7 de febrero de 2019, de la Dirección Área Rectora de la Salud de Alajuela, del Ministerio de Salud.”
“En relación a la información facilitada por su dependencia, mediante el oficio DVOP-DIDV- 1VD-2021-177, relacionada con los lotes baldíos ubicados en la provincia de Alajuela y que cuentan con órdenes sanitarias, se informa que fue incorporada al cuadro Excel de seguimiento que lleva esta dependencia, copia adjunta, y expuesto el pasado miércoles 14 de abril ante el Grupo de Trabajo, para ser atendidos apenas las condiciones lo permitan, dada el escaso personal e implementos con que cuenta la Dirección de Seguridad y Embellecimiento de Carreteras, cuyo plan de trabajo incluye intervenciones en todo el país.” (El destacado y subrayado no son del original) 2022-
Los anteriores lotes del Estado, fueron objeto de denuncias de la Asociación de Desarrollo de Río Segundo y tuvieron la Orden Sanitaria N” CZ-00004-2019 de fecha 7 de febrero de 2019, de la Dirección de Área Rectora de la Salud de Alajuela, del Ministerio de Salud. (...) Son los mismos lotes intervenidos la vez anterior por la Comisión que usted preside, a los cuales les volvió a crecer la maleza.” (El destacado y subrayado no son del original)
“Buenas tardes. Como usted indica en algún momento se le solicitó a la Dirección de Seguridad y Embellecimiento de Carreteras en colaboración con la Regional de Obras Públicas de Alajuela, colaboración para la limpieza de lotes ubicados en la Dirección01, sin embargo, también se le recomendó al Ing. [Nombre01 001] , Presidente de la [Nombre01 002], solicitud Unidad Ejecutora San José San Ramón de CONAVI, ya que es la instancia que debe atender y dar solución a estos temas.” (El destacado y subrayado no son del original)
“En relación a su denuncia para la limpieza de lotes del Estado destinado al proyecto vial San José-San Ramón; de conformidad con lo instruido por la División Administrativa de este Ministerio, favor dirigir la solicitud a la Unidad Ejecutora San José San Ramón de CONAVI, ya que es la instancia que debe atender y dar solución a estos temas. El Gerente General de la Unidad Ejecutora San José-San Ramón, es el Ingeniero Pablo Camacho Salazar, y su correo electrónico es: ...08 a quien les estamos copiando este correo.” (El destacado y subrayado no son del original)
“Estimado, con lo aportado es suficiente. Muchos gracias por su colaboración.” (El destacado y subrayado no son del original)
“Para su información y para lo que corresponda, se le adjunta el oficio número ADI-R5- 011-2022 de fecha 13 de julio de 2022, de seguimiento a la denuncia por limpieza de lotes del Estado en Río Segundo de Alajuela y en las cercanías del Dirección02, de la Junta Directiva de la [Nombre01 002] .” (El destacado y subrayado no son del original)
“(...) de acuerdo con lo establecido en Plan de Transición de la Conservación Vial que forma parte de dicha Cesión, le corresponde a la Gerencia de Conservación de Vías y Puentes de Conavi, el mantenimiento de la vía, hasta el inicia de la fase constructiva del Proyecto Integral. Por lo que, determinado que, en lo que respecta a las labores que son competencia del Conavi para la atención de dicha denuncio, corresponde la chapeo de estos terrenos que hacen parte del Derecho de Vía del proyecto, se procedió a remitir a la Gerencia de Conservación de Vías y Puentes del Conavi, y correo y la documentación, parte esto mediante oficio UESR-08-202-393 del 03 de junio del 2022.” (El destacado y subrayado no son del original)
“Conforme lo anterior expuesto, recomendamos a la UESR, que de nuevo solicite u la Gerencia de Conservación Vial de CONAVI realizar el mantenimiento de los terrenos que forman parte del derecho de vía en el sector de Río Segundo de Alajuela .” (El destacado y subrayado no son del original)
“En virtud de lo anterior y tal como se indicó en el correo del 20 de agosto, esta Unidad Ejecutora continuará dende seguimiento a fin de que estos labores de chapea, sean consideradas por parte de la Gerencia de Conservación Vial, tan pronto como se activen los contratos que permitan atender lo solicitado por su estimable persona.” (El destacado y subrayado no son del original) Del lo expuesto supra se colige que:
El Departamento de Inspección Vial y Demoliciones en todo momento ha actuado conforme a derecho en el presente asunto, incluso ha realizado limpieza periódica de los lotes objeto del presente Recurso de Amparo, en conjunto y con el apoyo de la División de Obras Públicas y la Dirección de Seguridad y Embellecimiento de Carreteras, desde el mes de enero del 2019, Asimismo, a raíz de la conformación de la Comisión en el seno de la División Administrativa, presidida por el señor Christian Méndez Blanco, para la atención de las órdenes sanitarias sobre lotes del Estado, desde abril del 2021, se le remitió el presente caso a dicha Comisión para la atención del mismo a través de la Dirección de Seguridad y Embellecimiento de Carreteras.
Asimismo, desde el mes de mayo del presente año, el Consejo Nacional de Vialidad (CONAVI) asumió la competencia en el presente asunto, particularmente a través de la Gerencia de Conservación de Vías y Puentes de dicho Consejo.
Por tal motivo, tanto el Departamento de Inspección Vial y Demoliciones, como la División de Obras Públicas, hemos actuado apegados al marco de legalidad, en estricto cumplimiento de los deberes que nos asisten como funcionarios públicos. 2022”.
“EN CUANTO A LOS HECHOS Y EL FONDO:
Desde la fecha de conocimiento de la denuncia interpuesta por el señor [Nombre 001], en su condición de Presidente de la [Nombre01 002], la División de Obras Públicas, coordinó las gestiones pertinentes por medio de sus dependencias, en específico, el Departamento de Inspección Vial y Demoliciones, de la Subdirección de Diseño Vial, de la Dirección de Ingeniería, en conjunto con la Dirección de Seguridad y Embellecimiento de Carreteras de la División Administrativa, y la Dirección Regional de Alajuela, todos del MOPT, para atender lo denunciado.
Además, se recomendó al denunciante presentar su denuncia ante la Unidad Ejecutora San José San Ramón de CONAVI, ya que era la instancia que debía atender y dar solución a esos temas.
Asimismo, el documento recibido el 13 de julio de 2022 con oficio N° ADI-RS-011-2022, suscrito por el señor [Nombre01 001] , en representación de la [Nombre01 002], se puso en conocimiento de la Unidad Ejecutora San José San Ramón de CONAVI, y ésta a su vez, puso dicho documento en conocimiento de la Gerencia de Conservación de Vías y Puentes del CONAVI para que ellos procedieran con la limpieza de los lotes conforme el ámbito de sus competencias.
Siendo que mediante oficio N° UAP-FSJSR-2022-08-972 de fecha 25 de agosto de 2022, el Fideicomiso del Proyecto San José San Ramón, le indicó a la Unidad Ejecutora que solicitará a la Gerencia de Conservación de Vías y Puentes del CONAVI, realizar el mantenimiento de los terrenos que forman parte del derecho de vía en el sector de Río Segundo de Alajuela.
Y en su defecto, mediante el oficio N° UESR-08-2022-620 (717) de fecha 02 de setiembre de 2022, la Unidad Ejecutora le comunicó al señor [Nombre01 001] , Presidente de la [Nombre01 002], que continuarían dando seguimiento a fin de que esas labores de chapea, sean consideradas por parte de la Gerencia de Conservación de Vías y Puentes del CONAVI, tan pronto se activen los contratos que permitan atender lo solicitado por su representada.
En seguimiento a las gestiones realizadas por las dependencias del MOPT (Departamento de Inspección Vial y Demoliciones, Embellecimiento de Carreteras de la División Administrativa y la Dirección Regional de Alajuela) y de conformidad con las competencias de la División de Obras Públicas, realizaremos una visita a los terrenos denunciados para verificar el estado actual de los mismos y coordinar las gestiones que sean necesarias para atender lo que corresponda, a fin de brindar una solución a lo denunciado y posteriormente, se estará comunicando a la Sala las gestiones realizadas por parte del MOPT.”.
“CONSIDERACIONES PREVIAS:
En el escrito de interposición del presente recurso de amparo, el señor [Nombre01 001] según manifiesta- funge como el presidente y representante legal de la [Nombre01 005] empero, de la revisión realizada del expediente judicial N°22- 023074-0007-CO conformada por 112 páginas, se visualiza que no se aporta la personería jurídica de la Asociación de marras, misma que -se considera- debió proporcionar el aquí recurrente con la finalidad de constatar que se encuentra legitimado para actuar con las facultades que la ley otorga.
La resolución de las quince horas y catorce minutos del catorce de octubre del dos mil veintidós, fue notificada al Consejo Nacional de Vialidad a las nueve horas quince minutos del día veinte de octubre del dos mil veintidós; por lo que se procede a responder cada uno de los hechos ahí mencionados, en el tiempo y forma de ley.
A su vez, la resolución de previa cita indica:
[…]
En primer lugar, el Consejo Nacional de Vialidad no hará referencia a los hechos emanados propiamente al Ministerio de Obras Públicas y Transportes, por no ser parte de las competencias de esta Administración.
En cuanto a la manifestación realizada por el amparado, es importante resaltar que los terrenos descritos son propiedad del Ministerio de Obras Públicas y Transportes -tal cual lo alega el amparado.
Es preciso destacar que, los correos electrónicos visualizados en el expediente judicial, son direcciones electrónicas institucionales válidas de los funcionarios del Consejo Nacional de Vialidad; además se encuentra la dirección electrónica ...09 que está conformada para la recepción de documentación, tanto en soporte físico como digital, en amparo a la Directriz No. DIE15-003-D fechado 09 de junio del 2015 en acatamiento al oficio N° ACA 01-15-0309 emitida por el Consejo de Administración en la misma fecha, con la finalidad de atender la remisión de solicitudes, denuncias, disconformidades, quejas y demás documentos.
Cabe señalar que el correo electrónico ...06 es un correo electrónico atinente de los funcionarios del CONAVI, que si bien es cierto son propiamente correos electrónicos oficiales de esta institución más no es el medio idóneo para presentar una disconformidad, quejas o denuncias.
[…]
Ahora bien, de acuerdo al informe técnico oficio GCSV-130-2022-3255 del 20 de octubre de 2022 emitido por la Gerencia de Conservación de Vías y Puentes, resalta la ingeniería de la zona que, al Consejo Nacional de Vialidad le compete únicamente la Conservación Vial en las vías y puentes, más no el mantenimiento de terrenos -objeto de este caso- en amparo a la Ley N°7798 denominada Ley de Creación del Consejo Nacional de Vialidad, se extrae en lo que interesa:
(…) “Al respecto y por motivos de las competencias indicadas en la Ley No. 7798 Ley de Creación del Consejo Nacional de Vialidad (CONAVI), la Conservación Vial corresponde a:
“… conjunto de actividades destinadas a preservar, de forma continua y sostenida, el buen estado de las vías y los puentes, de modo que se garantice un servicio óptimo al usuario. La conservación vial comprende todo lo que no alcanza a ser construcción de obras nuevas o variación sustancial de estándar de las existentes. Tampoco comprende las obras de restauración que se requieren a causa de emergencias, salvo lo dispuesto por la presente ley como excepción. Dentro de la conservación vial pueden distinguirse las siguientes actividades: mantenimiento (rutinario y periódico), refuerzo, rehabilitación y mejoramientos puntuales.” (El subrayado no es del original).
De tal forma, se evidencia que la Ley que sustenta y define las responsabilidades del CONAVI refiere a la Conservación Vial propiamente en las vías y puentes, por lo que al referirse el recurrente al mantenimiento de terrenos excede el alcance de esta Gerencia de Conservación de este Consejo. “ (…)

De la misma prueba aportada por el recurrente, se evidencia que, el funcionario de este Consejo; Ing. Jorge Aurelio Córdoba Fernández, anuncia al amparado sobre la competencia real del CONAVI e indica -inclusive- a quien debe dirigirse propiamente, del cual, corresponde al departamento de División de Obras Públicas del Ministerio de Obras Públicas y Transporte.
Siguiendo la misma línea, indica la ingeniería del sitio que, en apego al inciso N°10 de las funciones explicitas propias de la Dirección de Ingeniería de Obras Públicas del Ministerio de Obras Públicas y Transportes es:
(…) “10. Coordinar y gestionar lo correspondiente al control de los terrenos adquiridos por el Estado para la construcción de obras públicas; así como vigilar y controlar todo lo referente al uso de los derechos de vía de los caminos públicos y remanentes.” También el inciso No. 19 corresponde a funciones de las Direcciones Regionales del MOPT, se indica que deben:
“19. Colaborar, en lo que sea posible, con la dependencia encargada del registro y control de los terrenos, en la limpieza de terrenos y bienes muebles que pertenecen al MOPT.” (…)
Este Consejo, solo debe dar atención a lo que la ley le faculta y no realizará labores que no son propias de esta Administración. Es importante traer a colación lo que por disposiciones normativas le corresponden a este Consejo, así, la Ley de Creación del Consejo Nacional de Vialidad, en sus artículos 1, 3, y 4 define los alcances de la labor encomendada a este Consejo, la cual versa sobre la construcción y conservación de la red vial nacional, así como los objetivos de este, de manera que la respuesta brindada en el presente asunto es consecuente con su ley de creación.
“ARTÍCULO 1.- La presente ley regula la construcción y conservación de las carreteras, calles de travesía, pares viales y puentes de la red vial nacional…” (…)
ARTÍCULO 3.- Créase el Consejo Nacional de Vialidad, órgano con desconcentración máxima, adscrito al Ministerio de Obras Públicas y Transportes. El Consejo tendrá personalidad jurídica instrumental y presupuestaria para administrar el Fondo de la red vial nacional, así como para suscribir los contratos y empréstitos necesarios para el ejercicio de sus funciones, de conformidad con la presente ley…” ARTÍCULO 4.- Serán objetivos del Consejo Nacional de Vialidad los siguientes:
Como lo evidencia el articulado de cita, y en virtud del principio de legalidad establecido tanto en la Constitución Política como en la Ley General de la Administración Pública (artículo 11 ambos cuerpos normativos), este Consejo solo puede actuar en virtud de lo que en normativa está permitido, siendo que lo solicitado por parte del señor [Nombre01 001] , va más allá de las funciones que tiene el CONAVI, pues la misma como ya se indicó, se encarga de las labores de conservación vial, por lo que la ley en su artículo 4 le establece sus objetivos.
Cabe señalar que, de acuerdo al informe técnico oficio GCTT-18-2022-0401 fechado 21 de octubre del 2022 emitido por la Gerencia de Contratación de Vías y Puentes, indica explícitamente la contratación directa que -a solicitud de la Gerencia de Conservación de Vías y Puentes- fue adjudicada para el mantenimiento de la Red Vial Nacional en la zona de conservación 1-4 de la Región Central, señalando cada una de las actividades ejecutadas, donde reza a continuación:
(…) “En relación a la zona de conservación 1-4, la Gerencia de Contratación de Vías y Puentes, a solicitud de una contratación por parte de la Gerencia de Conservación de Vías y Puentes, tramitó la Contratación Directa No. 2021CD-000048-0006000001, “Chapea del derecho de vía de la Red Vial Nacional en la zona 1-4 Alajuela Sur; Región Central”.
El proceso fue publicado en la plataforma del Sistema Integrado de Compras Públicas (SICOP), el 10 de noviembre de 2021. La apertura de ofertas se dio el 22 de noviembre de 2021. El 20 de diciembre de 2021 se adjudicó la obra a la Grupo Lauher Sociedad Anónima. El contrato No. 043202230090000300 fue notificado el 18 de febrero de 2022; por un plazo de ejecución de 180 días naturales.
Actualmente la Gerencia de Contratación de Vías y Puentes, a solicitud de la Gerencia de Conservación de Vías y Puentes, se encuentra promoviendo una contratación para el mantenimiento básico de la Red Vial Nacional en la Dirección01.
Dentro de las actividades de mantenimiento básico que se contratarán en las Rutas Nacionales que se localizan en la Dirección02, se encuentran, limpieza de cunetas y canales revestidos de manera manual, limpieza de tomas, cabezales y alcantarillas, brigada de limpieza de derecho de vía y activos viales, brigada de limpieza de puentes, descuaje de árboles y remoción de derrumbes.
Cabe mencionar que, el Conavi de acuerdo a sus competencias, llevará a cabo las intervenciones que realice, dentro del derecho de vía de la Red Vial Nacional.” (…)
Conviene recordar que el legislador se desencantó por encomendar funciones a diferentes instituciones y asignar recursos específicos para el desarrollo de las mismas. Dentro de este orden de ideas, el CONAVI solo puede ejecutar las labores que le facultan dentro del marco de la ley 7798 “Ley de Creación del Consejo Nacional de Vialidad” y, según se ha indicado, el CONAVI no ha incurrido en ninguna falta que afecte al amparado.
En conclusión, se considera que el Consejo Nacional de Vialidad no ha lesionado los derechos fundamentales del amparado, ni tampoco ha hecho omisión alguna en la solución a la problemática expuesta, se reitera que la institución competente corresponde al Ministerio de Obras Públicas y Transportes.”.
“INFORME A efectos de estructurar nuestra respuesta y refutar los alegatos esgrimidos por la parte recurrente, conviene en la especie, referirse de forma puntual a cada uno de dichos alegatos, estableciendo nuestros argumentos de orden jurídico y técnico.
Conforme lo expuesto, se procede a continuación a esbozar nuestros argumentos de hecho y de derecho.
Sobre el Rol del Ministerio de Obras Públicas y Transportes En el caso concreto, en fecha 21 de julio del 2022, se recibió en este Despacho, el oficio N° ADIRS-2022-011, suscrito por el señor [Nombre01 001] , Presidente de la Asociación de Desarrollo de Río Segundo de Alajuela, mediante el cual denunciaba sobre la problemática en un terreno del MOPT con frentes en vía nacional tanto en la Dirección03, como en la Dirección04, en el sector de Río Segundo de Alajuela.
En atención a lo denunciado, mediante Traslado de Correspondencia N°DM-TC-2022-1123, de fecha 10 de agosto del 2022, este Despacho procedió con el trámite correspondiente y remitió al Departamento de Inspección Vial y Demoliciones el oficio N° ADI-RS-011-2022 citado, para ser atendido conforme las competencias otorgadas por ley al Departamento.
Así las cosas, Lic. Roque Campos Anchía, funcionario del Departamento de Inspección Vial y Demoliciones, a través de mensaje de correo electrónico de fecha 19 de agosto del 2022, remitió al Ingeniero Andrés Henao Fernández, de la Unidad Ejecutora San José-San Ramón, el documento N° ADI-RS-011-2022, de fecha 13 de julio del 2022, suscrito por el señor [Nombre01 001] , Presidente de la [Nombre01 002], indicando:
“Para su información y para lo que corresponda, se le adjunta el oficio número ADIRS-011-2022 de fecha 13 de julio de 2022, de seguimiento a la denuncia por limpieza de lotes del Estado en Río Segundo de Alajuela y en las cercanías del Dirección02, de la Junta Directiva de la [Nombre 011] ” (El destacado y subrayado no son del original) Mediante mensaje de correo electrónico de fecha 20 de agosto del 2022, el Ingeniero Andrés Henao Fernández, de la Unidad Ejecutora San José-San Ramón, le responde al Lic. Roque Campos Anchía, funcionario del Departamento de Inspección Vial y Demoliciones, con relación al documento N° ADI-RS-011-2022, de fecha 13 de julio del 2022, suscrito por el señor [Nombre01 001] , Presidente de la [Nombre01 002], lo de interés:
“(…) de acuerdo con lo establecido en Plan de Transición de la Conservación Vial que forma parte de dicha Cesión, le corresponde a la Gerencia de Conservación de Vías y Puentes de Conavi, el mantenimiento de la vía, hasta el inicio de la fase constructiva del Proyecto Integral. Por lo que, determinado que, en lo que respecta a las labores que son competencia del Conavi para la atención de dicha denuncia, corresponde la chapea de estos terrenos que hacen parte del Derecho de Vía del proyecto, se procedió a remitir a la Gerencia de Conservación de Vías y Puentes del Conavi, y correo y la documentación, aportados por parte del señor Nombre02, esto mediante oficio UESR-08-202-393 del 03 de junio del 2022.” (El destacado y subrayado no son del original) Posteriormente mediante el oficio N°UESR-08-2022-590 fecha 26 de agosto del 2022, el Ingeniero Andrés Henao Fernández, de la Unidad Ejecutora San José-San Ramón, le remitió a la Gerencia de Conservación de Vías y Puentes la información actualizada sobre la intervención de los inmuebles objeto del presente recurso, a efecto de que se proceda con la limpieza de los lotes, conforme al ámbito de su competencia.
Mediante oficio N°UAP-FSJSR-2022-08-972, fecha 25 de agosto del 2022, el Fideicomiso del Proyecto San José-San Ramón, indicó lo siguiente:
“Conforme lo anterior expuesto, recomendamos a la UESR, que de nuevo solicite a la Gerencia de Conservación Vial de CONAVI realizar el mantenimiento de los terrenos que forman parte del derecho de vía en el sector de Río Segundo de Alajuela.” (El destacado y subrayado no son del original) Mediante oficio N°UESR-08-2022-620 (717), fecha 02 de setiembre del 2022, de la Unidad Ejecutora del Proyecto San José-San Ramón, dirigido al Ingeniero [Nombre01 001], Presidente de la [Nombre01 002], se señaló:
“En virtud de lo anterior y tal como se indicó en el correo del 20 de agosto, esta Unidad Ejecutora continuará dando seguimiento a fin de que estas labores de chapea, sean consideradas por parte de la Gerencia de Conservación Vial, tan pronto como se activen los contratos que permitan atender lo solicitado por su estimable persona.” (El destacado y subrayado no son del original) Cabe señalar que según lo indicado líneas supra, este Despacho del Ministro de Obras Públicas y Transportes ha actuado apegado al ordenamiento jurídico, incluso el Departamento de Inspección Vial y Demoliciones y la División de Obras Públicas, ente que según señaló en el oficio N° DVOP-2022-1473 del 24 de octubre del 2022, suscrito por el Ing. Alonso Mora Arroyo, realizará una visita a los terrenos denunciados para verificar el estado actual de los mismos y coordinar las gestiones que sean necesarias para atender lo que corresponda, dentro del ámbito de sus competencias.
Sobre los correos electrónicos.
Señaló también la resolución de las quince horas catorce minutos del catorce de octubre de dos mil veintidós: “Además, la autoridad recurrida deberá informar si los correos electrónicos, a los cuales la parte recurrente remitió las solicitudes están previsto como mecanismo oficial para la recepción de gestiones de los usuarios” Sobre este particular es menester señalar que concretamente las gestiones dirigidas al Despacho del Ministro de Obras Públicas y Transportes, deben enviarse a la dirección electrónica oficial para recibir documentación, sea el correo electrónico: ...10.
No omito indicar que a la fecha el correo electrónico ...01, no corresponde a ningún funcionario de la institución.”.
“1.-En referencia a lo señalado por el amparado y de los antecedentes que constan en esta Área Rectora de Salud, se tiene que, en el año 2019 mediante oficio DVOP-DI-DV-IVD-2019-40 el Ministerio de Obras Públicas y Transportes, informó a los denunciantes que en relación con su petición estarían realizando labores de mantenimiento en los inmuebles referidos. Con referencia a lo señalado en los puntos 1, 2 y 3, considera el suscrito, que deberías ser los funcionarios del Ministerio de Obras Públicas y Transportes, quienes emitan criterio.
Esta instancia ha dado atención y respuesta tanto a lo requerido por la Defensoría de los Habitantes, como a lo solicitado por la señora Adriana Cordero Jiménez. Se han respetado los plazos de valoración y respuesta a lo solicitado y las competencias, remitiendo el asunto a la institución responsable (MOPT), para que realice la atención de dicho asunto.”.
Redacta el Magistrado Cruz Castro ; y,
Considerando:
El recurrente expuso que el Ministerio de Obras Públicas y Transportes posee varios terrenos en Río Segundo de Alajuela, los cuales conforman parte de proyectos viales futuros (Radial Río Segundo Panasonic, y ampliación de la Dirección05). Debido al abandono se han convertido en botaderos de escombros y basura y son usados como “motel” y para el desarrollo de fiestas clandestinas donde se consume licor y drogas y se ponen equipos de audio a un volumen elevado. Desde el 2018 se han presentado gestiones ante el MOPT, pero el problema no se resuelve. Pretenden con este amparo lo siguiente:
“Nuestra petitoria ante esta situación es que se declare con lugar el recurso de amparo y de manera urgente:
1-Plan de mantenimiento rutinario para los terrenos.
2-Cerramiento perimetral de los terrenos para evitar el ingreso de vehículos, a mejor resolver por parte del MOPT, para evitar el estacionamiento de vehículos así como la contaminación sónica que estos ocasionan a los vecinos del lugar.
3-Plan de administración de los terrenos para evitar estas situaciones a futuro.
Según los alcances de los señores magistrados al respecto de este caso”.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
A.- En relación con el Ministerio de Obras Públicas y Transportes y el Consejo Nacional de Vialidad 1) Mediante el documento de fecha 18 de diciembre del 2018, el Ingeniero [Nombre01 001], Presidente de la Asociación de Desarrollo de Río Segundo de Alajuela (ADI), solicitó al MOPT la limpieza de los lotes objeto del presente Recurso de Amparo (informe rendido).
Los anteriores lotes del Estado, fueron objeto de denuncias de la Asociación de Desarrollo de Río Segundo y tuvieron la Orden Sanitaria N” CZ-00004-2019 de fecha 7 de febrero de 2019, de la Dirección de Área Rectora de la Salud de Alajuela, del Ministerio de Salud. (...) Son los mismos lotes intervenidos la vez anterior por la Comisión que usted preside, a los cuales les volvió a crecer la maleza.” (informe rendido).
“Buenas tardes. Como usted indica en algún momento se le solicitó a la Dirección de Seguridad y Embellecimiento de Carreteras en colaboración con la Regional de Obras Públicas de Alajuela, colaboración para la limpieza de lotes ubicados en la Dirección01, sin embargo, también se le recomendó al Ing. [Nombre01 001], Presidente de la [Nombre01 002], solicitud Unidad Ejecutora San José San Ramón de CONAVI, ya que es la instancia que debe atender y dar solución a estos temas.” (informe rendido).
“En relación a su denuncia para la limpieza de lotes del Estado destinado al proyecto vial San José-San Ramón; de conformidad con lo instruido por la División Administrativa de este Ministerio, favor dirigir la solicitud a la Unidad Ejecutora San José San Ramón de CONAVI, ya que es la instancia que debe atender y dar solución a estos temas. El Gerente General de la Unidad Ejecutora San José-San Ramón, es el Ingeniero Pablo Camacho Salazar, y su correo electrónico es: ...08 a quien les estamos copiando este correo.” (informe rendido) 23) Mediante mensaje de correo electrónico de fecha 01 de junio del 2022, el Ingeniero Andrés Henao Fernández, de la Unidad Ejecutora San José-San Ramón, le comunicó al Lic. Roque Campos Anchía, funcionario del Departamento de Inspección Vial y Demoliciones, al ponerle este último en conocimiento la denuncia del señor [Nombre01 001], Presidente de la [Nombre01 002], y remitirle los documentos concernientes al caso, lo siguiente:
“Estimado, con lo aportado es suficiente. Muchos gracias por su colaboración.” (informe rendido).
“Para su información y para lo que corresponda, se le adjunta el oficio número ADI-R5- 011-2022 de fecha 13 de julio de 2022, de seguimiento a la denuncia por limpieza de lotes del Estado en Río Segundo de Alajuela y en las cercanías del Dirección02, de la Junta Directiva de la [Nombre01 002].” (informe rendido).
“(...) de acuerdo con lo establecido en Plan de Transición de la Conservación Vial que forma parte de dicha Cesión, le corresponde a la Gerencia de Conservación de Vías y Puentes de Conavi, el mantenimiento de la vía, hasta el inicia de la fase constructiva del Proyecto Integral. Por lo que, determinado que, en lo que respecta a las labores que son competencia del Conavi para la atención de dicha denuncia, corresponde la chapeo de estos terrenos que hacen parte del Derecho de Vía del proyecto, se procedió a remitir a la Gerencia de Conservación de Vías y Puentes del Conavi, y correo y la documentación, parte esto mediante oficio UESR-08-202-393 del 03 de junio del 2022.” (informe rendido).
“Conforme lo anterior expuesto, recomendamos a la UESR, que de nuevo solicite u la Gerencia de Conservación Vial de CONAVI realizar el mantenimiento de los terrenos que forman parte del derecho de vía en el sector de Río Segundo de Alajuela .” (informe rendido).
“En virtud de lo anterior y tal como se indicó en el correo del 20 de agosto, esta Unidad Ejecutora continuará dando seguimiento a fin de que estos labores de chapea, sean consideradas por parte de la Gerencia de Conservación Vial, tan pronto como se activen los contratos que permitan atender lo solicitado por su estimable persona.” (informe rendido).
B.- En relación con el Área Rectora de Salud de Alajuela 1 31) En el 2019 mediante oficio DVOP-DI-DV-IVD-2019-40 el Ministerio de Obras Públicas y Transportes, informó a los denunciantes que en relación con su petición estarían realizando labores de mantenimiento en los inmuebles referidos (informe rendido).
III.Sobre el fondo . En relación con el tema expuesto, esta Sala se ha pronunciado en múltiples oportunidades. Recientemente, en sentencia 2022003203 de las 9:30 horas del 11 de febrero del 2022, citando su propia jurisprudencia, indicó lo siguiente:
“Sobre el derecho a la salud y a un ambiente sano y ecológicamente equilibrado. Debe indicarse, en primer lugar, que los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Constitución Política), así como a través de la normativa internacional aplicable en Costa Rica. En este sentido, en sentencia n.° 2006-5928 de las 15:00 horas del 02 de mayo del 2006, este Tribunal resolvió:
“El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la República. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental. Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública.
En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de “ calidad ambiental” como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras – principio de desarrollo sostenible – .” Asimismo, del artículo 50 de la Constitución Política se deriva la obligación del Estado de proteger el ambiente. Norma que establece al efecto:
"El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes".
Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado” .
IV.Caso concreto. En primer término, se debe aclarar que el recurrente no pretende una respuesta formal a las denuncias presentadas. Al contrario, él mismo afirma y aporta documentación al respecto, sí ha recibido oficios por parte de las autoridades recurridas en contestación a lo que les expuso. La pretensión del amparo es que se solucione el problema. Al respecto, de conformidad con los informes bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción, se comprueba que el recurrente denunció la situación aquí expuesta tanto ante el MOPT como al Ministerio de Salud. En efecto, originalmente mediante el documento de fecha 18 de diciembre del 2018, el Ingeniero [Nombre01 001], Presidente de la Asociación de Desarrollo de Río Segundo de Alajuela (ADI), solicitó al MOPT, en oficio número 18-2018, del que aporta copia, la limpieza de los lotes objeto del presente Recurso de Amparo.
A raíz de la denuncia. Ante la denuncia, el Departamento de Inspección Vial y Demoliciones, verificó el problema. Por mensaje del 16 de enero del 2019, el Departamento de Inspección Vial y Demoliciones, le comunicó al señor [Nombre01 001] lo siguiente: “Le comunico que ya se hizo la inspección de campo y se están gestionando los recursos necesarios para la atención del caso, para incluirlo en nuestro plan de trabajo.” Por su parte, el 30 de enero del 2019, la Dirección Área Rectora de Salud Alajuela 1, de la Dirección Regional de Rectoría de la Salud Central Norte, del Ministerio de Salud, comunicó al Departamento de Inspección Vial y Demoliciones la orden sanitaria número CZ-00004-2019. En acato de esta orden los días 01, 04, 05, 06 y 07 de febrero del 2019, funcionarios del Departamento de Inspección Vial y Demoliciones, se apersonaron en los inmuebles de cita, a realizar labores de limpieza en dichos lotes, con la colaboración de la Regional de Alajuela de la División de Obras Públicas.
Mediante el documento No ADI-RS-002-2021, de fecha 21 de enero del 2021, el Ingeniero [Nombre01 001], Presidente de la Asociación de Desarrollo de Río Segundo de Alajuela (ADI), solicitó nuevamente al MOPT la intervención de los lotes objeto del presente Recurso de Amparo. Posteriormente, el 12 de mayo del 2022, a solicitud del Departamento de Inspección Vial y Demoliciones de la Subdirección de Diseño Vial de la Dirección de Ingeniería de la División de Obras Públicas (y debido a la comunicación que realizara la Asociación de Desarrollo de Río Segundo el día 11 de mayo del 2022), el Departamento de Inspección Vial y Demoliciones, con el fin de corroborar la situación actual de los lotes objeto del presente recurso de amparo, y para constatar la eventual intervención en sitio conforme lo indicado en el oficio No DVA-2021-146 referido, se realizó una inspección ocular de los predios, lográndose comprobar la existencia de maleza en un 90% del área de los terrenos de repetida cita.
Mediante mensaje de correo electrónico de fecha 25 de mayo del 2022, el Licenciado Roque Campos Anchía, funcionario del Departamento de Inspección Vial y Demoliciones, le comunicó el Lic. Christian Méndez Blanco, Subdirector Administrativo, lo conducente: “Con instrucciones del Jefe del Departamento, y en relación con el oficio número DVA- 2021-67 de la División Administrativa de este Ministerio, relacionado a la intervención de lotes del Estado con ordenes sanitarias; se le solicita si es factible incluir de nuevo los lotes del Estado ubicados sobre la Dirección01, frente al Dirección02 y en Río Segundo de Alajuela, los cuales fueron intervenidos anteriormente por esa Comisión. Los anteriores lotes del Estado, fueron objeto de denuncias de la Asociación de Desarrollo de Río Segundo y tuvieron la Orden Sanitaria N” CZ-00004-2019 de fecha 7 de febrero de 2019, de la Dirección de Área Rectora de la Salud de Alajuela, del Ministerio de Salud.
(...) Son los mismos lotes intervenidos la vez anterior por la Comisión que usted preside, a los cuales les volvió a crecer la maleza.” Mediante mensaje de correo electrónico de fecha 30 de mayo del 2022, el Licenciado Roque Campos Anchía, funcionario del Departamento de Inspección Vial y Demoliciones, le comunicó al señor [Nombre01 001] , Presidente de la [Nombre01 002], lo de interés: “En relación a su denuncia para la limpieza de lotes del Estado destinado al proyecto vial San José-San Ramón; de conformidad con lo instruido por la División Administrativa de este Ministerio, favor dirigir la solicitud a la Unidad Ejecutora San José San Ramón de CONAVI, ya que es la instancia que debe atender y dar solución a estos temas. El Gerente General de la Unidad Ejecutora San José-San Ramón, es el Ingeniero Pablo Camacho Salazar, y su correo electrónico es: ...08 a quien les estamos copiando este correo.” Mediante mensaje de correo electrónico de fecha 01 de junio del 2022, el Ingeniero Andrés Henao Fernández, de la Unidad Ejecutora San José-San Ramón, le comunicó al Lic. Roque Campos Anchía, funcionario del Departamento de Inspección Vial y Demoliciones, al ponerle éste último en conocimiento la denuncia del señor [Nombre01 001], Presidente de la [Nombre01 002], y remitirle los documentos concernientes al caso, lo siguiente: “Estimado, con lo aportado es suficiente.
Muchos gracias por su colaboración.” Mediante el documento No ADI-RS-011-2022, de fecha 13 de julio del 2022, el Ingeniero [Nombre01 001], Presidente de la Asociación de Desarrollo de Río Segundo de Alajuela (ADI), solicitó nuevamente al MOPT (específicamente al señor Ministro de Obras Públicas y Transportes) la intervención de los lotes objeto del presente Recurso de Amparo. Mediante Traslado de Correspondencia No DM-TC-2022-1123, de fecha 10 de agosto del 2022, el Despacho del señor Ministro remitió al Departamento de Inspección Vial y Demoliciones de la Subdirección de Diseño Vial de la Dirección de Ingeniería de la División de Obras Públicas el oficio “ADI-R5- 011-2022 citado, para ser atendido conforme las competencias otorgadas por ley al Departamento. Por otra parte, mediante mensaje de correo electrónico de fecha 19 de agosto del 2022, se remitió al Ingeniero Andrés Henao Fernández, de la Unidad Ejecutora San José-5an Ramón, por parte del Lic. Roque Campos Anchía, funcionario del Departamento de Inspección Vial y Demoliciones, el documento No ADI-RS-011-2022, de fecha 13 de julio del 2022, suscrito por el señor [Nombre01 001] , Presidente de la [Nombre01 002], indicando: “Para su información y para lo que corresponda, se le adjunta el oficio número ADI-R5- 011-2022 de fecha 13 de julio de 2022, de seguimiento a la denuncia por limpieza de lotes del Estado en Río Segundo de Alajuela y en las cercanías del Dirección02, de la Junta Directiva de la [Nombre01 002] .” Mediante mensaje de correo electrónico de fecha 20 de agosto del 2022, el Ingeniero Andrés Henao Fernández, de la Unidad Ejecutora San José-San Ramón, le responde al Lic. Roque Campos Anchía, funcionario del Departamento de Inspección Vial y Demoliciones, con relación al documento No ADI-R5-011-2022, de fecha 13 de julio del 2022, suscrito por el señor [Nombre01 001] , Presidente de la [Nombre01 002], lo de interés: “(...) de acuerdo con lo establecido en Plan de Transición de la Conservación Vial que forma parte de dicha Cesión, le corresponde a la Gerencia de Conservación de Vías y Puentes de Conavi, el mantenimiento de la vía, hasta el inicia de la fase constructiva del Proyecto Integral.
Por lo que, determinado que, en lo que respecta a las labores que son competencia del Conavi para la atención de dicha denuncia, corresponde la chapeo de estos terrenos que hacen parte del Derecho de Vía del proyecto, se procedió a remitir a la Gerencia de Conservación de Vías y Puentes del Conavi, y correo y la documentación, parte esto mediante oficio UESR-08-202-393 del 03 de junio del 2022.” Mediante oficio No UESR-08-2022-590 fecha 26 de agosto del 2022, el Ingeniero Andrés Henao Fernández, de la Unidad Ejecutora San José-San Ramón, le remite a la Gerencia de Conservación de Vías y Puentes la información actualizada sobre la intervención de los inmuebles objeto del presente recurso, a los efectos de que se proceda a la limpieza de los lotes conforme al ámbito de su competencia. Mediante oficio No UAP-FSISR-2022-08-972, fecha 25 de agosto del 2022, el Fideicomiso del Proyecto San José-San Ramón, indicó lo siguiente: “Conforme lo anterior expuesto, recomendamos a la UESR, que de nuevo solicite u la Gerencia de Conservación Vial de CONAVI realizar el mantenimiento de los terrenos que forman parte del derecho de vía en el sector de Río Segundo de Alajuela .” Mediante oficio No UESR-08-2022-620 (717), fecha 02 de setiembre del 2022,de la Unidad Ejecutora del Proyecto San José-San Ramón, dirigido al Ingeniero [Nombre01 001], Presidente de la [Nombre01 002], se señaló: “En virtud de lo anterior y tal como se indicó en el correo del 20 de agosto, esta Unidad Ejecutora continuará dando seguimiento a fin de que estos labores de chapea, sean consideradas por parte de la Gerencia de Conservación Vial, tan pronto como se activen los contratos que permitan atender lo solicitado por su estimable persona.” Por otro lado el Área Rectora de Salud de Alajuela 1 recibió la denuncia en el año 2019 y, como se indicó emitió orden sanitaria CZ-00004-2019 al Ministerio de Obras Públicas y Transportes a fin de que el Departamento Vial procediera a la limpieza de los terrenos citados.
Asimismo, en referencia al ordenamiento mediante oficio DVOP-DI-DV-IVD-217-17, funcionarios del Ministerio de Obras Públicas y Transportes informaron el cumplimiento del acto administrativo girado. De lo anterior se desprende claramente, que el problema denunciado subsiste. Ahora bien, por una parte, el Gerente de Conservación de Vías y Puentes del Consejo Nacional de Vialidad argumenta que no es el CONAVI sino el MOPT el encargado de resolver el problema. Por otra parte, el Jefe del Departamento de Inspección Vial y Demoliciones de la Subdirección de Diseño Vial de la Dirección de Ingeniería de la División de Obras Públicas argumenta que le corresponde al CONAVI hacerlo. Al respecto, es muy claro que se trata de dos órganos que en última instancia conforman el Ministerio de Obras Públicas y Transportes, de manera que no le corresponde al usuario ni tampoco a esta Sala definir a cuál le corresponde.
La organización interna es competencia del mismo ministerio. Por otra parte, es también muy claro que la denuncia fue originalmente interpuesta en diciembre del 2018. En ese momento el Departamento de Inspección Vial y Demoliciones de la Subdirección de Diseño Vial de la Dirección de Ingeniería de la División de Obras Públicas realizó inspecciones. La orden sanitaria se dirigió precisamente a ese departamento. No resulta de recibo que, en este momento, simplemente atribuya la responsabilidad a otro departamento u órgano. De igual forma, es claro que el CONAVI también que la Unidad Ejecutora San José-San Ramón explicó por qué el CONAVI debe también intervenir en la solución. En tercer término, la denunciar original, como se indicó, es del mes de diciembre del 2018 de manera que la Administración ha contado con suficiente tiempo para definir las responsabilidades específicas. La falta de coordinación no puede justificar la omisión en resolver un problema ya verificado.
En consecuencia, el amparo debe estimarse contra el MOPT incluido el CONAVI. Por otro lado, el Área Rectora de Salud de Alajuela 1 indica ahora que, por ser un lugar abierto y en vía pública, le corresponde al Ministerio de Obras Públicas como encargado de las vías, a la Policía de Tránsito, a la Fuerza Pública y a la Policía Municipal intervenir. Sobre el particular, se observa que originalmente el Área de Salud sí dictó una orden sanitaria. No es aquí el caso que simplemente no pueda ahora intervenir. Por otra parte, pese que el terreno pertenece al Estado, lo cierto es que, entre otras cosas, en este amparo se indica que se utiliza para depositar basura, con los consiguientes problemas que esto puede acarrear. Dada la naturaleza del problema, que es continuo dado que se trata en gran medida de falta de mantenimiento, el Ministerio de Salud debe mantenerse vigilante y emitir las órdenes sanitarias que sea necesario. Dado que no lo ha hecho, el amparo también debe estimarse contra el Ministerio de Salud.
V.Voto salvado parcial respecto a la parte dispositiva de esta sentencia de la Magistrada Garro Vargas. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso solucionar el problema denunciado por la parte recurrente relacionado con una serie de terrenos del Ministerio de Obras Públicas, que son utilizados clandestinamente como botaderos y de fiestas clandestinas. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a la parte recurrente que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. En consecuencia, se le ordena a Carlos Arguedas Chaverri, Director del Área Rectora de Salud Alajuela 1, o a quien ocupe ese cargo, que realice las gestiones necesarias para que, en el plazo de un mes, contado a partir de la notificación de esta sentencia, inspeccione el lugar denunciado y dicte las órdenes sanitarias pertinentes. De igual forma, se le ordena a Luis Esteban Amador Jiménez, Ministro de Obras Públicas y Transportes, a Alonso Mora Arroyo, Dirección General de la División de Obras Públicas, a Vinicio Barboza Ortiz, Jefe del Departamento de Inspección Vial y Demoliciones de la Subdirección de Diseño Vial de la Dirección de Ingeniería de la División de Obras Públicas, todos del Ministerio de Obras Públicas y Transportes, y a Pablo Camacho Salazar, Gerente de Conservación de Vías y Puentes del Consejo Nacional de Vialidad, o a quienes ocupen esos cargos, que, en el plazo de un año, contado a partir de la notificación de esta sentencia, realicen las gestiones necesarias para solucionar el problema denunciado.
Se advierte que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y al Consejo Nacional de Vialidad al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La Magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
