Amparo action processed in expediente no. 22-021954-0007-CO, filed by [Name 001], identity card [Value 001], against the NATIONAL SYSTEM OF CONSERVATION AREAS (SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN, SINAC) of the MINISTRY OF ENVIRONMENT AND ENERGY (MINISTERIO DE AMBIENTE Y ENERGÍA, MINAE).

**Whereas:** 1.- By brief incorporated into the digital expediente on September 29, 2022, the claimant files an amparo action against SINAC of MINAE. He states that on April 25, 2022, he filed a complaint for the alleged constructive invasion of more than 100 homes, in which he requested to be informed of the actions carried out by SINAC; however, he has not received a copy of the investigation report. He alleges that on September 5, 2022, he made a request for information, but as of the 26th of that month, they had not responded. He requests that the action be granted and that an order be issued to provide him with a copy of the final investigation report.

2.- By resolution issued at 16:35 hours on September 30, 2022, the Presidency of the Chamber warned the claimant to provide "a complete, legible copy with the respective proof of receipt or email submission of the request for information that he claims to have made before the respondent authority and whose lack of response he alleges in the brief filing this proceeding." 3.- By record of October 10, 2022, Luis Ardón Acuña and Mariane Castro Villalobos, in their order secretary and technician, both of this Chamber, made it known: "reviewed, in the COSTA RICAN JUDICIAL CASE MANAGEMENT SYSTEM, the CONTROL OF DOCUMENTS RECEIVED AND THIS EXPEDIENTE, it does not appear that from 09/30/2022 to 10/07/2022, the claimant has submitted any brief or document, to comply with what was warned in the resolution at sixteen hours thirty-five minutes on September thirtieth of two thousand twenty-two." 4.- By resolution issued at 20:27 hours on October 14, 2022, the Presidency of the Chamber admitted the amparo action and requested a report from the head of the Subregional Office of Grecia of SINAC.

5.- By brief received at the Secretariat of the Chamber at 13:03 hours on October 24, 2022, Luis Alonso González Arce renders his sworn report, in his capacity as head of the Subregional Office of Grecia of SINAC. He sets forth the following: "Below, I provide a chronological summary of the actions of this functional unit of SINAC, as well as clarifications regarding the case at hand. 1. In relation to what was requested by Mr. [Name 001], regarding that, I quote literally, '...that it be investigated in the following properties whether there are constructions within the protection zone of the El Patal spring (naciente). 435343-329640-322583-336612-437300-444351-455220-386554-208376555 189-565152-198718. And property No. 2850...'. In this regard, the due investigation efforts were carried out, which I proceed to detail: 1.1. In response to the environmental complaint with consecutive number 36465-2022 from the Integrated System for Processing and Handling Environmental Complaints (Sistema integrado de Trámite y Atención de Denuncias Ambientales, SITADA), the subregional office of SINAC of Grecia conducted a series of investigative efforts (geographical analysis of the area, consultations with the municipality of Grecia, among others), including field inspections performed in August on the reported properties to verify the reported facts; from these inspections, the following factual reports were generated: SINAC-ACC-OG-inf-0985-2022, SINAC-ACC-OG-inf-0986-2022, SINAC-ACC-OG-inf-0987-2022, SINAC-ACC-OG-inf-0988-2022, SINAC-ACC-OG-inf-0989-2022, SINAC-ACC-OG-inf-0990-2022; SINAC-ACC-OG-inf-0991-2022, SINAC-ACC-OG-inf-0992-2022, SINAC-ACC-OG-inf-0994-2022, SINAC-ACC-OG-inf-0995-2022; SINAC-ACC-OG-inf-0996-2022; SINAC-ACC-OG-inf-0997-2022, SINAC-ACC-OG-inf-0998-2022, SINAC-ACC-OG-inf-0999-2022, SINAC-ACC-OG-inf-1000-2022, SINAC-ACC-OG-inf-1001-2022, SINAC-ACC-OG-inf-1002-2022, SINAC-ACC-OG-inf-1003-2022, SINAC-ACC-OG-inf-1004-2022. 1.2. On September 27, 2022, Mr. Cecilio Chacón Soto, an official of the subregional office of SINAC of Grecia, sent an email to Mr. Manuel Segura, an official of the Municipality of Grecia, in which he requested information on the existence of municipal permits, expansions, earthworks (movimientos de tierra), or others regarding properties No.: 374116, 374117, 208376, 374122, 374121, 377648, 198718, 322583, 437300, 329640, 4444352, 208376, 198374, 316549, 316547, 331441, 368553, 333151, 249766, and 230033; as all of them were found invading protection areas and in response to the environmental complaint with consecutive number 364652022 from SITADA. 1.3. On October 10, 2022, Ms. Yorleny Abarca Bogarín, an official of the municipality of Grecia, delivered to the subregional office of SINAC of Grecia via email official letter IM-6938-2022, providing information in response to the request made on September 27, 2022, by Mr. Cecilio Chacón Soto, an official of the subregional office of SINAC of Grecia. 1.4. On October 13, 2022, Mr. Cecilio Chacón Soto, an official of the subregional office of SINAC of Grecia, sent a functional directive via email to Mr. Alejandro Alpízar Arrones, an official of the Adjunta Agrario Ambiental Prosecutor's Office, in which he requested a legal opinion on the actions being taken in response to the environmental complaint with consecutive number 36465-2022 (SITADA). 1.5. On October 19, 2022, Mr. Alejandro Alpízar Arrones, an official of the Adjunta Agrario Ambiental Prosecutor's Office, responded to the functional directive made to him on October 13, 2022, by Mr. Cecilio Chacón Soto, an official of the subregional office of SINAC of Grecia. 1.6. On October 21, 2022, Eng. Maikol Rodríguez Gómez, an official of the subregional office of SINAC of Grecia, following up on the Functional Directive made to Mr. Alejandro Alpízar Arrones, an official of the Adjunta Agrario Ambiental Prosecutor's Office, and in response to the environmental complaint with consecutive number 36465-2022 (SITADA), sent the factual report with official letter SINAC-ACC-OG-inf-09852022, via email ([email protected]), to the Judicial Investigation Agency of Grecia, for the relevant investigations to be carried out. 1.7. Official letter SINAC-ACC-OG-inf-0985-2022 is on record, with which the factual report regarding property No. 2-0198374-000 is sent to the Judicial Investigation Agency. 1.8. On October 21, 2022, Eng. On October 21, 2022, Eng. On October 21, 2022, Eng. Joseph Antonio Acuña Cruz, an official of the subregional office of SINAC of Grecia, following up on the Functional Directive made to Mr. Alejandro Alpízar Arrones, an official of the Adjunta Agrario Ambiental Prosecutor's Office, and in response to the environmental complaint with consecutive number 36465-2022 (SITADA), sent the factual report with official letter SINAC-ACCOG-inf-1004-2022, via email ([email protected]), to the Judicial Investigation Agency of Grecia, for the relevant investigations to be carried out. 1.43, Official letter SINAC-ACC-OG-inf-1004-2022 is on record, with which the factual report regarding property No. 2-0377648-000 is sent to the Judicial Investigation Agency. 2 . In relation to what was requested by Mr. [Name 001], regarding that, I quote literally, 'Ley 7575 art 33 its protection radius is 200 mts (sic.). Therefore, I request that the investigation be conducted within the 200-meter radius...'. In this regard, Mr. [Name 001] is not correct regarding the reference he makes to the 200-meter radius, according to the rule cited by him, I clarify this by quoting literally the provisions of Article 33 of the Ley Forestal No. 7575, on this particular: 'a) The areas bordering permanent springs (nacientes), defined within a radius of one hundred meters measured horizontally…' 3. In relation to what was requested by Mr. [Name 001], regarding that, I quote literally, '… AMELIA SPRING (NACIENTE AMELIA), MUNICIPAL PROPERTY ... I request that the investigation apply fully Ley No. 7575 art 33. the 200 mts (sic) since (sic) it is captured for human population consumption...'. In this regard, Mr. [Name 001] is not correct regarding the reference he makes to the rule cited by him (Art. 33, Ley Forestal 7575), in relation to the 200-meter radius, given that this is captured for human consumption, since, as previously indicated, Ley Forestal No. 7575 establishes a radius of 100 meters, not 200 meters. 4. What was stated by Mr. [Name 001], regarding that, to date, no information has been notified to him about the complaint he filed, is incorrect, since, on September 27, 2022, Mr. Cecilio Chacón Soto, an official of the subregional office of SINAC of Grecia, sent an email to Mr. Chavarría, at the email provided by him ([email protected]), detailing the following: Mr. [Name 001] Dear Sir, I inform you that, in addressing a complaint filed by you for apparent invasions of spring (naciente) protection areas in accordance with Ley Forestal 7575, it was accepted and processed under SITADA: 36465-2022 and during said investigation it was obtained: That, during the field inspections carried out and analysis using Geographic Information Systems, it is concluded that: Within the protection area of the spring (naciente) with determination (dictamen): DA-UHTPCOSJ-0026-2018 (El Patal) the following properties are located: 1. Property 374116 there is a construction of 191 square meters between 82 and 99 meters distance from the spring (naciente). 2. Property 374117 there is a construction of 115 square meters between 89 and 99 meters distance from the spring (naciente). 3. Property 208376 there is a construction of 106 square meters between 77 and 90 meters distance from the spring (naciente). 4. Property 374122 there is a construction of 176 square meters between 89 and 99 meters distance from the spring (naciente). 5. Property 374121 there is a construction of 125 square meters between 88 and 100 meters distance from the spring (naciente). 6. Property 377648 there is a construction of 24 square meters between 95 and 100 meters distance from the spring (naciente). Within the protection area of the spring (naciente) with determination (dictamen): DA-UHTPCOSR-0099-2020 (unnamed) the following properties are located: 1. Property 198718 there are crops and removal of the topsoil layer covering approximately 6893 square meters between 21 and 99 meters distance from the spring (naciente). 2. Property 322583 there is a construction of 100 square meters between 88 and 99 meters distance from the spring (naciente). 3. Property 437300 there is a construction of 206 square meters between 79 and 82 meters distance from the spring (naciente). 4. Property 329640 there is a construction of 292 square meters between 97 and 99 meters distance from the spring (naciente). 5. Property 444352 there is a construction of 140 square meters between 82 and 95 meters distance from the spring (naciente). 6. Property 208376 there is a construction of 98 square meters between 74 and 88 meters distance from the spring (naciente). Within the protection area of the spring (naciente) with determination (dictamen): AT-0025-2012 (Amelia) the following properties are located: 1. Property 198374 there are crops and removal of the topsoil layer covering approximately 7162 square meters between 18 and 99 meters distance from the spring (naciente). 2. Property 316549 there is a construction of 274 square meters between 75 and 96 meters distance from the spring (naciente). 3. Property 316547 there is a construction of 151 square meters between 68 and 89 meters distance from the spring (naciente). 4. Property 331441 there is a construction of 72 square meters between 70 and 91 meters distance from the spring (naciente). 5. Property 368553 there is a construction of 80 square meters between 81 and 94 meters distance from the spring (naciente). 6. Property 333151 there is a construction of 141 square meters between 85 and 98 meters distance from the spring (naciente). 7. Property 249766 there is a wall with an approximate area of 100 square meters between 43 and 93 meters distance from the spring (naciente). 8. Property 230033 there is a construction of 99 square meters between 09 and 20 meters distance from the spring (naciente). Therefore, Ley Forestal No. 7575, Article 33, because the foregoing cited locations are within the 100-meter protection radius, the corresponding factual reports were prepared with official letters SINAC-ACC-OG-inf-880-2022, SINAC-ACC-OG-inf882-2022, SINAC-ACC-OG-inf-883-2022, and SINAC-ACC-OG-inf-886-2022. Given the breadth of the investigation and the required analysis, and that said structures are not recent, information is still pending from some properties regarding municipal permits and when they were built, as well as the respective functional directives. This information will be sent as an addendum to the cases to the Judicial Investigation Agency, for a better resolution of the facts found. This case originates from the complaint filed by [Name 001] before this SINAC office on April 25, 2022. Along with this official letter, I attach a CD with a PDF copy of the case file that this office manages in relation to the case at hand.'" 6.- In the proceedings followed, the legal requirements have been observed.

Drafted by Magistrate Rueda Leal; and, **Considering:** I.- Object of the action: The claimant files an amparo action against SINAC. He states that on April 25, 2022, he filed a complaint for the alleged constructive invasion of more than 100 homes, in which he requested to be informed of the actions carried out by SINAC; however, he has not received a copy of the investigation report. He alleges that on September 5, 2022, he made a request for information, but as of the 26th of that month, they had not responded. He requests that the action be granted and that an order be issued to provide him with a copy of the final investigation report. II.- Proven facts. Of importance for the decision in this matter, the following facts are considered duly proven: a) On April 25, 2022, the subregional office of Grecia of SINAC received a written complaint from the claimant with the following content: "(…) I hereby file the following FORMAL COMPLAINT, against the Municipality of Grecia, this as the governing body that grants construction permits (sic), and that has the responsibility to monitor and protect both laws and regulations, as well as the Urban Regulatory Plan. Reason for the complaint: For having granted construction permits (sic) in Protection Zones of the El Patal Spring (Naciente El Patal) and La Amelia Spring (Naciente La Amelia). Ley 7575 Article 33. (…) Having said the above, I state that an investigation be carried out in the following properties to determine if there are constructions within the protection zone of the El Patal Spring (Naciente El Patal). 435343- 329640- 322583- 336612- 437300- 444351-455220-386554- 208376- 555189- 565152- 198718. And Property No. 2850, the same corresponds to Plaza Shopping Center. Taking as a reference point the coordinates, NARANJO SHEET, LATITUDE 229.081 LONGITUDE 501-291 EL PATAL SPRING (NACIENTE EL PATAL), PROPERTY OF EL PATAL S.R.L According to (sic) expediente No.6518 of March 24, 2017, it states that it is captured for human population consumption. Therefore, Ley 7575 art 33, its protection radius is 200 mts. Therefore, I request that the investigation be conducted within the 200-meter radius, since Official Letter No.GAJ-043-2022 of April 22, 2022, responds to me with a 100-meter radius. I also request that the investigation be expanded, at the following coordinates: LATITUDE 229.520 LONGITUDE 502. 465 LA AMELIA SPRING (NACIENTE LA AMELIA), MUNICIPAL PROPERTY. According to expediente No 6518 of March 24, 2017, it states that it is captured for human population consumption. I request that the investigation fully apply Ley No. 7575 Article 33.

the 200 meters already (sic) is captured for human population consumption. Given such concern, I submit this and request before you: 1.- That this FORMAL COMPLAINT be assessed and that the appropriate action be taken in accordance with the law. 2.- That I be notified of all acts that the Sinac Grecia Office carries out henceforth regarding this complaint (…) notifications to the email address [email protected]”. (Evidence provided by the appellant). b) On September 27, 2022, the Grecia subregional office of SINAC sent the following information to the email address [email protected]: “Mr. [Name 001] Dear Sir, I inform you that, in addressing a complaint filed by you for apparent invasions into spring (naciente) protection areas in accordance with the Forest Law (Ley Forestal) 7575, it was accepted and processed under SITADA: 36465-2022, and during that investigation the following was obtained: That, during the field inspections carried out and analysis using Geographic Information Systems, it is concluded that: Within the spring protection area under opinion: DA-UHTPCOSJ-0026-2018 (El patal), the following properties are found: 1. Property 374116 has a construction of 191 square meters between 82 and 99 meters distance from the spring. 2. Property 374117 has a construction of 115 square meters between 89 and 99 meters distance from the spring. 3. Property 208376 has a construction of 106 square meters between 77 and 90 meters distance from the spring. 4. Property 374122 has a construction of 176 square meters between 89 and 99 meters distance from the spring. 5. Property 374121 has a construction of 125 square meters between 88 and 100 meters distance from the spring. 6. Property 377648 has a construction of 24 square meters between 95 and 100 meters distance from the spring. Within the spring protection area under opinion: DA-UHTPCOSR-0099-2020 (unnamed), the following properties are found: 1. Property 198718 has crops and removal of the vegetation layer of approximately 6893 square meters between 21 and 99 meters distance from the spring. 2. Property 322583 has a construction of 100 square meters between 88 and 99 meters distance from the spring. 3. Property 437300 has a construction of 206 square meters between 79 and 82 meters distance from the spring. 4. Property 329640 has a construction of 292 square meters between 97 and 99 meters distance from the spring. 5. Property 444352 has a construction of 140 square meters between 82 and 95 meters distance from the spring. 6. Property 208376 has a construction of 98 square meters between 74 and 88 meters distance from the spring. Within the spring protection area under opinion: AT-0025-2012 (Amelia), the following properties are found: 1. Property 198374 has crops and removal of the vegetation layer of approximately 7162 square meters between 18 and 99 meters distance from the spring. 2. Property 316549 has a construction of 274 square meters between 75 and 96 meters distance from the spring. 3. Property 316547 has a construction of 151 square meters between 68 and 89 meters distance from the spring. 4. Property 331441 has a construction of 72 square meters between 70 and 91 meters distance from the spring. 5. Property 368553 has a construction of 80 square meters between 81 and 94 meters distance from the spring. 6. Property 333151 has a construction of 141 square meters between 85 and 98 meters distance from the spring. 7. Property 249766 has a wall with an approximate area of 100 square meters between 43 and 93 meters distance from the spring. 8. Property 230033 has a construction of 99 square meters between 09 and 20 meters distance from the spring. Therefore, Forest Law No. 7575, article 33, because the aforementioned are located within the 100-meter protection radius, the corresponding incident reports were prepared under official communications SINAC-ACC-OG-inf-880-2022, SINAC-ACC-OG-inf882-2022, SINAC-ACC-OG-inf-883-2022, and SINAC-ACC-OG-inf-886-2022. Given the breadth of the investigation and the required analysis, and that these structures are not recent, information is still pending (sic) from some properties regarding municipal permits and when they were built, as well as the corresponding functional directives; such information will be forwarded as an addendum to the cases to the Judicial Investigation Agency (Organismo de Investigación Judicial), for a better resolution of the facts found”. (Report from the respondent authority). c) The head of the Grecia subregional office of SINAC reported that the following proceedings were carried out in response to the complaint filed by the claimant: “1.1. In response to environmental complaint sequential No. 36465-2022 from the Integrated System for Processing and Attention of Environmental Complaints (SITADA), the SINAC subregional office of Grecia carried out a series of investigation procedures (geographic analysis of the area, consultations with the municipality of Grecia, among others), including field inspections conducted in the month of August on the reported properties, in order to verify the reported facts. From these inspections, the following incident reports were generated: SINAC-ACC-OG-inf-0985-2022, SINAC-ACC-OG-inf-0986-2022, SINAC-ACC-OG-inf-0987-2022, SINAC-ACC-OG-inf-0988-2022, SINAC-ACC-OG-inf-0989-2022, SINAC-ACC-OG-inf-0990-2022; SINAC-ACC-OG-inf-0991-2022, SINAC-ACC-OG-inf-0992-2022, SINAC-ACC-OG-inf-0994-2022, SINAC-ACC-OG-inf-0995-2022; SINAC-ACC-OG-inf-0996-2022; SINAC-ACC-OG-inf-0997-2022, SINAC-ACC-OG-inf-0998-2022, SINAC-ACC-OG-inf-0999-2022, SINAC-ACC-OG-inf-1000-2022, SINAC-ACC-OG-inf-1001-2022, SINAC-ACC-OG-inf-1002-2022, SINAC-ACC-OG-inf-1003-2022, SINAC-ACC-OG-inf-1004-2022. 1.2. On September 27, 2022, Mr. Cecilio Chacón Soto, an official of the SINAC subregional office of Grecia, sent an email to Mr. Manuel Segura, an official of the Municipality of Grecia, in which he requests information on the existence of municipal permits, expansions, earthworks (movimientos de tierra), or others regarding the properties No.: 374116, 374117, 208376, 374122, 374121, 377648, 198718, 322583, 437300, 329640, 4444352, 208376, 198374, 316549, 316547, 331441, 368553, 333151, 249766, and 230033; as all of them are invading protection areas and in response to the environmental complaint with sequential No. 364652022 from SITADA. 1.3. On October 10, 2022, Mrs. Yorleny Abarca Bogarín, official of the municipality of Grecia, sent to the SINAC subregional office of Grecia via email official communication IM-6938-2022, providing information in response to the request made on September 27, 2022, by Mr. Cecilio Chacón Soto, official of the SINAC subregional office of Grecia. 1.4. On October 13, 2022, Mr. Cecilio Chacón Soto, official of the SINAC subregional office of Grecia, made a functional consultation via email to Mr. Alejandro Alpízar Arrones, official of the Deputy Agrarian Environmental Prosecutor's Office (Fiscalía Adjunta Agrario Ambiental), requesting criteria on the procedures being carried out in response to environmental complaint with sequential No. 36465-2022 (SITADA). 1.5. On October 19, 2022, Mr. Alejandro Alpízar Arrones, official of the Deputy Agrarian Environmental Prosecutor's Office, responded to the functional consultation made to him on October 13, 2022, by Mr. Cecilio Chacón Soto, official of the SINAC subregional office of Grecia. 1.6. On October 21, 2022, Mr. Maikol Rodríguez Gómez, official of the SINAC subregional office of Grecia, in follow-up to the Functional Consultation made to Mr. Alejandro Alpízar Arrones, official of the Deputy Agrarian Environmental Prosecutor's Office, and in response to environmental complaint with sequential No. 36465-2022 (SITADA), forwarded the incident report via official communication SINAC-ACC-OG-inf-09852022, by email ([email protected]), to the Judicial Investigation Agency of Grecia, so that the pertinent investigations may be carried out. 1.7. On October 21, 2022, Mr. Joseph Antonio Acuña Cruz, official of the SINAC subregional office of Grecia, in follow-up to the Functional Consultation made to Mr. Alejandro Alpízar Arrones, official of the Deputy Agrarian Environmental Prosecutor's Office, and in response to environmental complaint with sequential No. 36465-2022 (SITADA), forwarded the incident report via official communication SINAC-ACCOG-inf-1004-2022, by email ([email protected]), to the Judicial Investigation Agency of Grecia, so that the pertinent investigations may be carried out. 1.43. Official communication SINAC-ACC-OG-inf-1004-2022 is on record, by which the incident report regarding property No. 2-0377648-000 is forwarded to the Judicial Investigation Agency”. (Report from the respondent authority). d) On October 19, 2022, the respondent authority was notified of the course of this amparo. (Notification record). III.- On the specific case. In the sub lite, the claimant files an amparo appeal against SINAC. He indicates that on April 25, 2022, he filed a complaint for the alleged constructive invasion of more than 100 homes, in which he requested that the acts carried out by SINAC be communicated to him; however, he has not received a copy of the investigation report. He argues that on September 5, 2022, he made a request for information, but by the 26th of that month, he had not received a response. He requests that the appeal be granted and that they be ordered to provide him with a copy of the final investigation report. From the study of the case records, it is considered demonstrated that on April 25, 2022, the Grecia subregional office of SINAC received a document from the appellant with the following content: “(…) I present the following FORMAL COMPLAINT, against the Municipality of Grecia, this as the governing entity that grants construction (sic) permits, and which has the responsibility to monitor and protect both the laws and regulations, as well as the Urban Regulatory Plan (Plan Regulador Urbano). Reason for the complaint: For having granted construction (sic) permits in Protection Zones of the Spring El Patal and Spring La Amelia. Law 7575 article 33. (…) Having said this, I state that the following properties should be investigated to determine if there are constructions within the protection zone of Spring El Patal. 435343- 329640- 322583- 336612- 437300- 444351-455220-386554- 208376- 555189- 565152- 198718. And Property No. 2850, which corresponds to Plaza Shopping Center. Taking as a reference point the coordinates, HOJA DE NARANJO, LATITUDE 229.081 LONGITUDE 501-291 SPRING EL PATAL, PROPERTY OF EL PATAL S.R.L. According (sic) to file No. 6518 of March 24, 2017, it says that it is captured for human population consumption. Therefore, under Law 7575 art 33, its protection radius is 200 meters. For this reason, I request that the investigation be carried out within a 200-meter radius, since Official Communication No. GAJ-043-2022 of April 22, 2022, answers me with a 100-meter radius. I also request that the investigation be extended, at the following coordinates: LATITUDE 229.520 LONGITUDE 502.465 SPRING LA AMELIA, MUNICIPAL PROPERTY. According to file No. 6518 of March 24, 2017, it states that it is captured for human population consumption, I request that the investigation be applied fully under Law No. 7575 article 33. the 200 meters already (sic) is captured for human population consumption. Given such concern, I submit this and request before you: 1.- That this FORMAL COMPLAINT be assessed and that the appropriate action be taken in accordance with the law. 2.- That I be notified of all acts that the Sinac Grecia Office carries out henceforth regarding this complaint (…) notifications to the email address [email protected]”. On September 27, 2022, the Grecia subregional office of SINAC sent the following information to the email address [email protected]: “Mr. [Name 001] Dear Sir, I inform you that, in addressing a complaint filed by you for apparent invasions into spring protection areas in accordance with the Forest Law 7575, it was accepted and processed under SITADA: 36465-2022, and during that investigation the following was obtained: That, during the field inspections carried out and analysis using Geographic Information Systems, it is concluded that: Within the spring protection area under opinion: DA-UHTPCOSJ-0026-2018 (El patal), the following properties are found: 1. Property 374116 has a construction of 191 square meters between 82 and 99 meters distance from the spring. 2. Property 374117 has a construction of 115 square meters between 89 and 99 meters distance from the spring. 3. Property 208376 has a construction of 106 square meters between 77 and 90 meters distance from the spring. 4. Property 374122 has a construction of 176 square meters between 89 and 99 meters distance from the spring. 5. Property 374121 has a construction of 125 square meters between 88 and 100 meters distance from the spring. 6. Property 377648 has a construction of 24 square meters between 95 and 100 meters distance from the spring. Within the spring protection area under opinion: DA-UHTPCOSR-0099-2020 (unnamed), the following properties are found: 1. Property 198718 has crops and removal of the vegetation layer of approximately 6893 square meters between 21 and 99 meters distance from the spring. 2. Property 322583 has a construction of 100 square meters between 88 and 99 meters distance from the spring. 3. Property 437300 has a construction of 206 square meters between 79 and 82 meters distance from the spring. 4. Property 329640 has a construction of 292 square meters between 97 and 99 meters distance from the spring. 5. Property 444352 has a construction of 140 square meters between 82 and 95 meters distance from the spring. 6. Property 208376 has a construction of 98 square meters between 74 and 88 meters distance from the spring. Within the spring protection area under opinion: AT-0025-2012 (Amelia), the following properties are found: 1. Property 198374 has crops and removal of the vegetation layer of approximately 7162 square meters between 18 and 99 meters distance from the spring. 2. Property 316549 has a construction of 274 square meters between 75 and 96 meters distance from the spring. 3. Property 316547 has a construction of 151 square meters between 68 and 89 meters distance from the spring. 4. Property 331441 has a construction of 72 square meters between 70 and 91 meters distance from the spring. 5. Property 368553 has a construction of 80 square meters between 81 and 94 meters distance from the spring. 6. Property 333151 has a construction of 141 square meters between 85 and 98 meters distance from the spring. 7. Property 249766 has a wall with an approximate area of 100 square meters between 43 and 93 meters distance from the spring. 8. Property 230033 has a construction of 99 square meters between 09 and 20 meters distance from the spring. Therefore, Forest Law No. 7575, article 33, because the aforementioned are located within the 100-meter protection radius, the corresponding incident reports were prepared under official communications SINAC-ACC-OG-inf-880-2022, SINAC-ACC-OG-inf882-2022, SINAC-ACC-OG-inf-883-2022, and SINAC-ACC-OG-inf-886-2022. Given the breadth of the investigation and the required analysis, and that these structures are not recent, information is still pending (sic) from some properties regarding municipal permits and when they were built, as well as the corresponding functional directives; such information will be forwarded as an addendum to the cases to the Judicial Investigation Agency, for a better resolution of the facts found”. The head of the Grecia subregional office of SINAC reported that the following proceedings were carried out in response to the complaint filed by the claimant: “1.1.

In response to environmental complaint file number 36465-2022 of the Sistema integrado de Trámite y Atención de Denuncias Ambientales (SITADA), the SINAC subregional office in Grecia carried out a series of investigative actions (geographic analysis of the area, inquiries to the municipality of Grecia, among others), including field inspections in the month of August on the reported properties, in order to verify the reported facts. These inspections generated the following factual reports: SINAC-ACC-OG-inf-0985-2022, SINAC-ACC-OG-inf-0986-2022, SINAC- ACC-OG-inf-0987-2022, SINAC-ACC-OG-inf-0988-2022, SINAC- ACC-OG-inf-0989-2022, SINAC-ACC-OG-inf-0990-2022; SINAC- ACC-OG-inf-0991-2022, SINAC-ACC-OG-inf-0992-2022, SINAC- ACC-OG-inf-0994-2022, SINAC-ACC-OG-inf-0995-2022; SINAC- ACC-OG-inf-0996-2022; SINAC-ACC-OG-inf-0997-2022, SINAC- ACC-OG-inf-0998-2022, SINAC-ACC-OG-inf-0999-2022, SINAC- ACC-OG-inf-1000-2022, SINAC-ACC-OG-inf-1001-2022, SINAC- ACC-OG-inf-1002-2022, SINAC-ACC-OG-inf-1003-2022, SINAC- ACC-OG-inf-1004-2022. . 1.2. On September 27, 2022, Mr. Cecilio Chacón Soto, an official of the SINAC subregional office in Grecia, sent an email to Mr. Manuel Segura, an official of the Municipality of Grecia, in which he requested information on the existence of municipal permits, expansions, earthworks (movimientos de tierra), or others regarding properties No.: 374116, 374117, 208376, 374122, 374121, 377648, 198718, 322583, 437300, 329640, 4444352, 208376, 198374, 316549, 316547, 331441, 368553, 333151, 249766, and 230033; because all of them were found to be invading protection areas and in response to environmental complaint file number 364652022 of SITADA. 1.3. On October 10, 2022, Mrs. Yorleny Abarca Bogarín, an official of the municipality of Grecia, sent official letter IM-6938-2022 via email to the SINAC subregional office in Grecia, in which information is provided in response to the request made on September 27, 2022, by Mr. Cecilio Chacón Soto, an official of the SINAC subregional office in Grecia. 1.4. On October 13, 2022, Mr. Cecilio Chacón Soto, an official of the SINAC subregional office in Grecia, made a functional direction via email to Lic. Alejandro Alpízar Arrones, an official of the Fiscalía Adjunta Agrario Ambiental, in which he requested an opinion on the actions being taken in response to environmental complaint file number 36465-2022 (SITADA). 1.5. On October 19, 2022, Lic. Alejandro Alpízar Arrones, an official of the Fiscalía Adjunta Agrario Ambiental, responded to the functional direction made to him on October 13, 2022, by Mr. Cecilio Chacón Soto, an official of the SINAC subregional office in Grecia. 1.6. On October 21, 2022, Eng. Maikol Rodríguez Gómez, an official of the SINAC subregional office in Grecia, in follow-up to the Functional Direction made to Lic. Alejandro Alpízar Arrones, an official of the Fiscalía Adjunta Agrario Ambiental, and in response to environmental complaint file number 36465-2022 (SITADA), forwarded the factual report under official letter SINAC-ACC-OG-inf-09852022, via email ([email protected]), to the Organismo de Investigación Judicial of Grecia, so that the pertinent investigations are carried out. 1.7. Official letter SINAC-ACC-OG-inf-0985-2022 is on record, with which the factual report regarding property No. 2-0198374-000 is forwarded to the Organismo de Investigación Judicial. 1.8. Alejandro Alpízar Arrones, an official of the Fiscalía Adjunta Agrario Ambiental, and in response to environmental complaint file number 36465-2022 (SITADA), forwarded the factual report under official letter SINAC-ACC-OG-inf-1003-2022, via email ([email protected]), to the Organismo de Investigación Judicial of Grecia, so that the pertinent investigations are carried out. 1.41. Official letter SINAC-ACC-OG-inf-1003-2022 is on record, with which the factual report regarding property No. 2-329640-000 is forwarded to the Organismo de Investigación Judicial. 1.42. On October 21, 2022, Eng. Joseph Antonio Acuña Cruz, an official of the SINAC subregional office in Grecia, in follow-up to the Functional Direction made to Lic. Alejandro Alpízar Arrones, an official of the Fiscalía Adjunta Agrario Ambiental, and in response to environmental complaint file number 36465-2022 (SITADA), forwarded the factual report under official letter SINAC-ACCOG-inf-1004-2022, via email ([email protected]), to the Organismo de Investigación Judicial of Grecia, so that the pertinent investigations are carried out. 1.43. Official letter SINAC-ACC-OG-inf-1004-2022 is on record, with which the factual report regarding property No. 2-0377648-000 is forwarded to the Organismo de Investigación Judicial.” On October 19, 2022, the respondent authority was notified of the course of this amparo. From this perspective, in the terms set forth in the filing brief, any situation that, at this time, warrants the intervention of the Chamber is dismissed. In this regard, from the report rendered under oath it follows that, on September 27, 2022, the respondent authority sent an email to the complainant with the results of the investigation up to that point. Specifically, on that occasion it was indicated to him that SINAC had carried out field inspections and determined the existence of constructions within spring (naciente) protection areas on at least 20 properties; furthermore, it was explained to him that some investigations of several properties were pending regarding municipal permits and the construction dates, as well as that the information was going to be sent to the Organismo de Investigación Judicial. That is, two days before the filing of this appeal (September 29, 2022) he was informed of the status of the complaint. In addition, it is on record in the case file that, on September 27, 2022, the respondent body made a request for information to the Municipality of Grecia, which was answered on October 13 following. On this last day, SINAC requested direction from the Fiscalía Adjunta Agrario Ambiental, which responded on the 19th of that month. Finally, it is observed that on October 21, 2022, the respondent authority sent 19 official letters to the Organismo de Investigación Judicial. Now, the complainant specifically alleges that he has not been given a copy of the investigation report and that the request for information he made on September 5, 2022, was also not addressed. Regarding the first point, the appellant does not mention the date on which he requested the delivery of the photocopy of that document, so that, as he does not refer to an individualized situation, the constitutionality of such a general and abstract claim cannot be analyzed a priori. In relation to the alleged request for information of September 5, not only did he not provide it as evidence, but he did not specifically detail its content. It should be noted that, prior to proceeding with this amparo, the Presidency of the Chamber warned him to provide a copy of the request for information; however, he did not comply with said warning. Consequently, the second claim must also be dismissed. Based on the considerations set forth, the appeal is declared without merit.

IV.- Documentation provided to the case file. This Chamber must warn the appellant that if any document has been provided, whether on paper, as well as objects or evidence supported by any additional device, or by electronic, computer, magnetic, optical, telematic means or produced by new technologies, these must be withdrawn from the office, within a period of 30 business days, after receiving notification of this judgment, otherwise all of it will be destroyed in accordance with the provisions of the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena in session No. 27-11 of August 22, 2011, article XXVI and published in Boletín Judicial number 19 of January 26, 2012, as well as in the agreement approved by the Consejo Superior del Poder Judicial, in session No. 43-12 held on May 3, 2012, article LXXXI.

Por tanto: Se declara sin lugar el recurso.

Recurso de amparo que se tramita en el expediente nro. 22-021954-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC) del MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE).

Resultando:

1.- Por escrito incorporado al expediente digital el 29 de setiembre de 2022, el accionante interpone recurso de amparo contra el SINAC del MINAE. Indica que el 25 de abril de 2022 planteó una denuncia por la supuesta invasión constructiva de más de 100 viviendas, en la que pidió que se le comunicaran los actos que llevara a cabo el SINAC; sin embargo, no ha recibido copia del informe de la investigación. Aduce que el 5 de setiembre de 2022 hizo solicitud de información, pero al 26 de ese mes no le habían contestado. Pide que se declare con lugar el recurso y se ordene entregarle copia del informe final de la investigación. 2.- Mediante resolución de las 16:35 horas de 30 de setiembre de 2022, la Presidencia de la Sala le previno al recurrente aportar “copia completa, legible y con el respectivo comprobante de recibido o remisión de correo electrónico de la solicitud de información que aduce haber realizado ante la autoridad accionada y, cuya falta de respuesta alega en el memorial de interposición de este proceso”. 3.-Por constancia de 10 de octubre de 2022, Luis Ardón Acuña y Mariane Castro Villalobos, por su orden secretario y técnica, ambos de esta Sala, hicieron saber: “revisado, en el SISTEMA COSTARRICENSE DE GESTIÓN DE DESPACHOS JUDICIALES el CONTROL DE DOCUMENTOS RECIBIDOS Y ESTE EXPEDIENTE, no aparece que del 30/09/2022 al 07/10/2022, el recurrente haya presentado escrito o documento alguno, para cumplir con lo prevenido en la resolución de las dieciséis horas treinta y cinco minutos del treinta de setiembre de dos mil veintidós”. 4.- Mediante resolución de las 20:27 horas de 14 de octubre de 2022, la Presidencia de la Sala dio curso al amparo y solicitó informe al jefe de la Oficina Subregional de Grecia del SINAC . 5.- Por escrito recibido en la Secretaría de la Sala a las 13:03 horas de 24 de octubre de 2022, rinde informe bajo juramento Luis Alonso González Arce, en su condición de jefe de la Oficina Subregional de Grecia del SINAC. Expone lo siguiente: “A continuación, hago un resumen cronológico de las actuaciones de esta unidad funcional del SINAC, así como aclaraciones respecto del caso que nos ocupa. 1. En relación con lo solicitado por el Sr. [Nombre 001] , en cuanto a que, cito textualmente, "...que se investigue en las siguientes fincas si existe construcciones dentro de la zona de protección de la naciente El Patal. 435343-329640-322583-336612-437300-444351-455220-386554-208376555 189-565152-198718. Y la finca Nº 2850...". Al respecto se realizaron las debidas diligencias de investigación, las cuales procedo a detallar: 1.1. En atención a la denuncia ambiental con consecutivo Nº 36465-2022 del Sistema integrado de Trámite y Atención de Denuncias Ambientales (SITADA), la oficina subregional del SINAC de Grecia realizó una serie de gestiones de investigación (análisis geográfico de la zona, consultas a la municipalidad de Grecia, entre otras), entre las cuales, se realizaron inspecciones de campo en el mes de agosto a las propiedades denunciadas, con el fin de verificar los hechos denunciados, de estas inspecciones se generaron los siguientes informes de hechos: SINAC-ACC-OG-inf-0985-2022, SINAC-ACC-OG-inf-0986-2022, SINAC- ACC-OG-inf-0987-2022, SINAC-ACC-OG-inf-0988-2022, SINAC- ACC-OG-inf-0989-2022, SINAC-ACC-OG-inf-0990-2022; SINAC- ACC-OG-inf-0991-2022, SINAC-ACC-OG-inf-0992-2022, SINAC- ACC-OG-inf-0994-2022, SINAC-ACC-OG-inf-0995-2022; SINAC- ACC-OG-inf-0996-2022; SINAC-ACC-OG-inf-0997-2022, SINAC- ACC-OG-inf-0998-2022, SINAC-ACC-OG-inf-0999-2022, SINAC- ACC-OG-inf-1000-2022, SINAC-ACC-OG-inf-1001-2022, SINAC- ACC-OG-inf-1002-2022, SINAC-ACC-OG-inf-1003-2022, SINAC- ACC-OG-inf-1004-2022. 1.2. Con fecha 27 de setiembre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, envía correo electrónico al Sr. Manuel Segura, funcionario de la Municipalidad de Grecia en el cual, le solicita información sobre la existencia de permisos municipales, ampliaciones, movimientos de tierra u otros con respecto a las fincas Nº : 374116, 374117, 208376, 374122, 374121, 377648, 198718, 322583, 437300, 329640, 4444352, 208376, 198374, 316549, 316547, 331441, 368553, 333151, 249766 y 230033; por encontrase toda ellas, invadiendo áreas de protección y en atención a la denuncia ambiental con consecutivo Nº 364652022 del SITADA. 1.3. Con fecha 10 de octubre del 2022 la Sra. Yorleny Abarca Bogarín funcionaria de la municipalidad de Grecia, hace llegar a la oficina subregional del SINAC de Grecia vía correo electrónico el oficio IM-6938-2022, en el cual, se brinda información en atención a la solicitud hecha el 27 de setiembre del 2022, por el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia. 1.4. Con fecha 13 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, realiza dirección función vía correo electrónico al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, en la cual, le solicita criterio sobre las gestiones que se están realizando en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA). 1.5. Con fecha 19 de octubre del 2022, el Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, responde la dirección funcional realizada a su persona el 13 de octubre del 2022 por parte del Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia. 1.6. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-09852022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.7. Consta el oficio SINAC-ACC-OG-inf-0985-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0198374-000. 1.8. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-0986-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.9. Consta el oficio SINAC-ACC-OG-inf-0986-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0316549000. 1.10. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACCOG-inf-0987-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.11. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-1003-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.41. Consta el oficio SINAC-ACC-OG-inf-1003-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-329640-000. 1.42. Con fecha 21 de octubre del 2022, el Ing. Joseph Antonio Acuña Cruz, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACCOG-inf-1004-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.43, Consta el oficio SINAC-ACC-OG-inf-1004-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0377648-000. 2 . En relación con lo solicitado por el Sr. [Nombre 001], en cuanto a que, cito textualmente, “la ley 7575 art 33 su radio de protección es de 200 mts (sic.). Por lo que pido se haga la investigación en el radio de los 200 metros...”. Al respecto, el Sr. [Nombre 001] no lleva razón en cuanto a la referencia que hace del radio de los 200 metros, según la norma por él citada, aclaro esto citando textualmente lo establecido en el artículo 33 de la ley forestal Nº 7575, sobre este particular, “a) Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal…” 3. En relación con lo solicitado por el Sr. [Nombre 001], en cuanto a que, cito textualmente, “… NACIENTE AMELIA, PROPIEDAD MUNICIPAL ... pido que la investigación se aplique a cabalidad la ley Nº 7575 art 33. los 200 mts (sic) ya (sic) es captada para consumo humano poblacional...”. Al respecto, el Sr. [Nombre 001] no lleva razón en cuanto a la referencia que hace de la norma citada por él (art. 33, ley forestal 7575), en relación con el radio de los 200 metros, al ser esta captada pata consunto humano, pues, como se indicó anteriormente, la ley forestal Nº 7575 lo que establece es un radio de 100 metros, no de 200 metros. 4. No lleva razón lo indicado por el Sr. [Nombre 001], en cuanto a que, a la fecha no se le ha notificado información alguna sobre la denuncia interpuesta por él, ya que, con fecha 27 de septiembre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, envía correo electrónico al Sr. Chavarría, al correo suministrado por él ([email protected]), en el cual, se le detalla lo siguiente: Sr [Nombre 001] Estimado Le informo que, en la atención de una queja interpuesta por su persona por aparentes invasiones a áreas de protección de nacientes de conformidad con la Ley Forestal 7575, fue acogida y tramitada con el SITADA: 36465-2022 y durante dicha investigación se obtuvo: Que, durante las inspecciones realizadas en campo y análisis mediante Sistemas de información Geográfica se concluye que: Dentro del área de protección de la naciente con dictamen: DA-UHTPCOSJ-0026-2018 (El patal) se encuentran las siguientes fincas: 1. Finca 374116 existe una construcción de 191 metros cuadrados entre los 82 y 99 metros de distancia de la naciente. 2. Finca 374117 existe una construcción de 115 metros cuadrados entre los 89 y 99 metros de distancia de la naciente. 3. Finca 208376 existe una construcción de 106 metros cuadrados entre los 77 y 90 metros de distancia de la naciente. 4. Finca 374122 existe una construcción de 176 metros cuadrados entre los 89 y 99 metros de distancia de la naciente. 5. Finca 374121 existe una construcción de 125 metros cuadrados entre los 88 y 100 metros de distancia de la naciente 6. Finca 377648 existe una construcción de 24 metros cuadrados entre los 95 y 100 metros de distancia de la naciente. Dentro del área de protección de la naciente con dictamen: DA-UHTPCOSR-0099-2020 (sin nombre) se encuentran las fincas: 1. Finca 198718 existen cultivos y remoción de capa vegetal de aproximadamente 6893 metros cuadrados entre los 21 y 99 metros de distancia de la naciente. 2. Finca 322583 existe una construcción de 100 metros cuadrados entre los 88 y 99 metros de distancia de la naciente. 3. Finca 437300 existe una construcción de 206 metros cuadrados entre los 79 y 82 metros de distancia de la naciente. 4. Finca 329640 existe una construcción de 292 metros cuadrados entre los 97 y 99 metros de distancia de la naciente. 5. Finca 444352 existe una construcción de 140 metros cuadrados entre los 82 y 95 metros de distancia de la naciente. 6. Finca 208376 existe una construcción de 98 metros cuadrados entre los 74 y 88 metros de distancia de la naciente. Dentro del área de protección de la naciente con dictamen: AT-0025-2012 (Amelia) se encuentran las fincas: 1.Finca 198374 existen cultivos y remoción de capa vegetal de aproximadamente 7162 metros cuadrados entre los 18 y 99 metros de distancia de la naciente. 2. Finca 316549 existe una construcción de 274 metros cuadrados entre los 75 y 96 metros de distancia de la naciente. 3. Finca 316547 existe una construcción de 151 metros cuadrados entre los 68 y 89 metros de distancia de la naciente. 4. Finca 331441 existe una construcción de 72 metros cuadrados entre los 70 y 91 metros de distancia de la naciente 5. Finca 368553 existe una construcción de 80 metros cuadrados entre los 81 y 94 metros de distancia de la naciente. 6. Finca 333151 existe una construcción de 141 metros cuadrados entre los 85 y 98 metros de distancia de la naciente. 7. Finca 249766 existe un muro con un área de 100 metros cuadrados aproximados entre los 43 y 93 metros de distancia de la naciente. 8. Finca 230033 existe una construcción de 99 metros cuadrados entre los 09 y 20 metros de distancia de la naciente. Por tanto, Ley Forestal Nº 7575, artículo 33 por encontrarse lo anterior citado dentro del radio de los 100 metros de protección se confeccionaron los informes de hechos correspondientes con los oficios SINAC-ACC-OG-inf-880-2022, SINAC-ACC-OG-inf882-2022, SINAC-ACC-OG-inf-883-2022 y SINAC-ACC-OG-inf-886-2022. Dado la amplitud de la investigación y el análisis requerido y que dichas estructuras no son recientes, están pendientes de información aun (sic) de algunas fincas con respecto a los permisos municipales y cuando fueron construidos, así como las respectivas direcciones funcionales, dicha información será remitida para adenda de los casos al Organismo de Investigación Judicial, para una mejor resolución de los hechos encontrados. Este caso da origen con la denuncia interpuesta por [Nombre 001] ante esta dependencia del SINAC el 25 de abril del 2022. Junto con este oficio adjunto un cd con una copia en formato PDF del expediente que esta oficina maneja en relación con el caso en autos”. 6.- En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Rueda Leal ; y,

Considerando:

I.-Objeto del recurso: El accionante interpone recurso de amparo contra el SINAC. Indica que el 25 de abril de 2022 planteó una denuncia por la supuesta invasión constructiva de más de 100 viviendas, en la que pidió que se le comunicaran los actos que llevara a cabo el SINAC; sin embargo, no ha recibido copia del informe de la investigación. Aduce que el 5 de setiembre de 2022 hizo solicitud de información, pero al 26 de ese mes no le habían contestado. Pide que se declare con lugar el recurso y se ordene entregarle copia del informe final de la investigación. II.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: a) El 25 de abril de 2022, la oficina subregional de Grecia del SINAC recibió un escrito del recurrente con el siguiente contenido: “(…) presento la siguiente DENUNCIA FORMAL , contra la Municipalidad de Grecia, esta como ente rector que otorga los permisos contructivos (sic), y que tiene la responsabilidad de vigilar y proteger tanto las leyes y reglamentos, así como el Plan Regulador Urbano. Motivo de la denuncia: Por haber otorgado permisos contructivos (sic) en Zonas de protección de la Naciente El Patal, y Naciente La Amelia. Ley 7575 artículo 33. (…) Dicho lo anterior, manifiesto que se investigue en las siguientes fincas si existen construcciones dentro de la zona de protección de la Naciente El Patal. 435343- 329640- 322583- 336612- 437300- 444351-455220-386554- 208376- 555189- 565152- 198718. Y la Finca No. 2850 misma corresponde a Centro Comercial Plaza. Tomando como punto de referencia las coordenadas, HOJA DE NARANJO, LATITUD 229.081 LONGITUD 501-291 NACIENTE EL PATAL, PROPIEDAD DE EL PATAL S.R.L Segun (sic) expediente No.6518 del 24 de Marzo de 2017 dice que la misma es captada para consumo humano poblacional. Por lo que la Ley 7575 art 33 su radio de protección es de 200 mts. Por lo que pido, que se haga la investigación en el radio de los 200 metros, ya que el Oficio No.GAJ-043-2022 del 22 de Abril de 2022 me responde con un radio de 100 metros. Solicito también se amplíe la investigación, en las siguientes coordenadas: LATITUD 229.520 LONGITUD 502. 465 NACIENTE LA AMELIA, PROPIEDAD MUNICIPAL. Según expediente No 6518 del 24 de Marzo de 2017, el mismo dice que es captada para consumo humano poblacional, pido que la investigación se apliquen a cabalidad la Ley No. 7575 artículo 33. los 200 mts ya (sic) es captada para consumo humano poblacional. Ante tal preocupación, remito la presente y solicito ante usted: 1.- Que se valore esta DENUNCIA FORMAL y se haga lo correspondiente conforme a derecho. 2.- Que se me notifique de todos los actos que de ahora en adelante realice el Sinac Oficina de Grecia, con respecto a esta denuncia (…) notificaciones al correo electrónico [email protected]”. (Prueba aportada por el recurrente). b) El 27 de setiembre de 2022, la oficina subregional de Grecia del SINAC envió al correo electrónico [email protected] la siguiente información: “Sr [Nombre 001] Estimado Le informo que, en la atención de una queja interpuesta por su persona por aparentes invasiones a áreas de protección de nacientes de conformidad con la Ley Forestal 7575, fue acogida y tramitada con el SITADA: 36465-2022 y durante dicha investigación se obtuvo: Que, durante las inspecciones realizadas en campo y análisis mediante Sistemas de información Geográfica se concluye que: Dentro del área de protección de la naciente con dictamen: DA-UHTPCOSJ-0026-2018 (El patal) se encuentran las siguientes fincas: 1. Finca 374116 existe una construcción de 191 metros cuadrados entre los 82 y 99 metros de distancia de la naciente. 2. Finca 374117 existe una construcción de 115 metros cuadrados entre los 89 y 99 metros de distancia de la naciente. 3. Finca 208376 existe una construcción de 106 metros cuadrados entre los 77 y 90 metros de distancia de la naciente. 4. Finca 374122 existe una construcción de 176 metros cuadrados entre los 89 y 99 metros de distancia de la naciente. 5. Finca 374121 existe una construcción de 125 metros cuadrados entre los 88 y 100 metros de distancia de la naciente 6. Finca 377648 existe una construcción de 24 metros cuadrados entre los 95 y 100 metros de distancia de la naciente. Dentro del área de protección de la naciente con dictamen: DA-UHTPCOSR-0099-2020 (sin nombre) se encuentran las fincas: 1. Finca 198718 existen cultivos y remoción de capa vegetal de aproximadamente 6893 metros cuadrados entre los 21 y 99 metros de distancia de la naciente. 2. Finca 322583 existe una construcción de 100 metros cuadrados entre los 88 y 99 metros de distancia de la naciente. 3. Finca 437300 existe una construcción de 206 metros cuadrados entre los 79 y 82 metros de distancia de la naciente. 4. Finca 329640 existe una construcción de 292 metros cuadrados entre los 97 y 99 metros de distancia de la naciente. 5. Finca 444352 existe una construcción de 140 metros cuadrados entre los 82 y 95 metros de distancia de la naciente. 6. Finca 208376 existe una construcción de 98 metros cuadrados entre los 74 y 88 metros de distancia de la naciente. Dentro del área de protección de la naciente con dictamen: AT-0025-2012 (Amelia) se encuentran las fincas: 1.Finca 198374 existen cultivos y remoción de capa vegetal de aproximadamente 7162 metros cuadrados entre los 18 y 99 metros de distancia de la naciente. 2. Finca 316549 existe una construcción de 274 metros cuadrados entre los 75 y 96 metros de distancia de la naciente. 3. Finca 316547 existe una construcción de 151 metros cuadrados entre los 68 y 89 metros de distancia de la naciente. 4. Finca 331441 existe una construcción de 72 metros cuadrados entre los 70 y 91 metros de distancia de la naciente 5. Finca 368553 existe una construcción de 80 metros cuadrados entre los 81 y 94 metros de distancia de la naciente. 6. Finca 333151 existe una construcción de 141 metros cuadrados entre los 85 y 98 metros de distancia de la naciente. 7. Finca 249766 existe un muro con un área de 100 metros cuadrados aproximados entre los 43 y 93 metros de distancia de la naciente. 8. Finca 230033 existe una construcción de 99 metros cuadrados entre los 09 y 20 metros de distancia de la naciente. Por tanto, Ley Forestal Nº 7575, artículo 33 por encontrarse lo anterior citado dentro del radio de los 100 metros de protección se confeccionaron los informes de hechos correspondientes con los oficios SINAC-ACC-OG-inf-880-2022, SINAC-ACC-OG-inf882-2022, SINAC-ACC-OG-inf-883-2022 y SINAC-ACC-OG-inf-886-2022. Dado la amplitud de la investigación y el análisis requerido y que dichas estructuras no son recientes, están pendientes de información aun (sic) de algunas fincas con respecto a los permisos municipales y cuando fueron construidos, así como las respectivas direcciones funcionales, dicha información será remitida para adenda de los casos al Organismo de Investigación Judicial, para una mejor resolución de los hechos encontrados”. (Informe de la autoridad recurrida). c) El jefe de la oficina subregional de Grecia del SINAC informó que se llevaron a cabo las siguientes diligencias en atención a la denuncia planteada por el accionante: “1.1. En atención a la denuncia ambiental con consecutivo Nº 36465-2022 del Sistema integrado de Trámite y Atención de Denuncias Ambientales (SITADA), la oficina subregional del SINAC de Grecia realizó una serie de gestiones de investigación (análisis geográfico de la zona, consultas a la municipalidad de Grecia, entre otras), entre las cuales, se realizaron inspecciones de campo en el mes de agosto a las propiedades denunciadas, con el fin de verificar los hechos denunciados, de estas inspecciones se generaron los siguientes informes de hechos: SINAC-ACC-OG-inf-0985-2022, SINAC-ACC-OG-inf-0986-2022, SINAC-ACC-OG-inf-0987-2022, SINAC-ACC-OG-inf-0988-2022, SINAC-ACC-OG-inf-0989-2022, SINAC-ACC-OG-inf-0990-2022; SINAC-ACC-OG-inf-0991-2022, SINAC-ACC-OG-inf-0992-2022, SINAC-ACC-OG-inf-0994-2022, SINAC-ACC-OG-inf-0995-2022; SINAC-ACC-OG-inf-0996-2022; SINAC-ACC-OG-inf-0997-2022, SINAC-ACC-OG-inf-0998-2022, SINAC-ACC-OG-inf-0999-2022, SINAC-ACC-OG-inf-1000-2022, SINAC-ACC-OG-inf-1001-2022, SINAC-ACC-OG-inf-1002-2022, SINAC-ACC-OG-inf-1003-2022, SINAC-ACC-OG-inf-1004-2022. 1.2. Con fecha 27 de setiembre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, envía correo electrónico al Sr. Manuel Segura, funcionario de la Municipalidad de Grecia en el cual, le solicita información sobre la existencia de permisos municipales, ampliaciones, movimientos de tierra u otros con respecto a las fincas Nº : 374116, 374117, 208376, 374122, 374121, 377648, 198718, 322583, 437300, 329640, 4444352, 208376, 198374, 316549, 316547, 331441, 368553, 333151, 249766 y 230033; por encontrase toda ellas, invadiendo áreas de protección y en atención a la denuncia ambiental con consecutivo Nº 364652022 del SITADA. 1.3. Con fecha 10 de octubre del 2022 la Sra. Yorleny Abarca Bogarín funcionaria de la municipalidad de Grecia, hace llegar a la oficina subregional del SINAC de Grecia vía correo electrónico el oficio IM-6938-2022, en el cual, se brinda información en atención a la solicitud hecha el 27 de setiembre del 2022, por el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia. 1.4. Con fecha 13 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, realiza dirección función vía correo electrónico al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, en la cual, le solicita criterio sobre las gestiones que se están realizando en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA). 1.5. Con fecha 19 de octubre del 2022, el Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, responde la dirección funcional realizada a su persona el 13 de octubre del 2022 por parte del Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia. 1.6. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-09852022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.7. Consta el oficio SINAC-ACC-OG-inf-0985-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0198374-000. 1.8. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-0986-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.9. Consta el oficio SINAC-ACC-OG-inf-0986-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0316549000. 1.10. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACCOG-inf-0987-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.11. Consta el oficio SINAC-ACC-OG-inf-0987-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0316547-000. 1.12. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-09882022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.13. Consta el oficio SINAC-ACC-OG-inf-0988-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0331441000. 1.14. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-09892022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.15. Consta el oficio SINAC-ACC-OG-inf-0989-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad NO 2-0368553000. 1.16. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-09902022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.17. Consta el oficio SINAC-ACC-OG-inf-0990-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0333151-000- 1.18. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACCOG-inf-099f-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.19. Consta el oficio SINAC-ACC-OG-inf-0991-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0249766000. 1.20. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-0992-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.21. Consta el oficio SINAC-ACC-OG-inf-0992-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-02300333-000. 1.22. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-0994-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.23. Consta el oficio SINAC-ACC-OG-inf-0994-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0374116-000.- 1.24. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-0995-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.25. Consta el oficio SINAC-ACC-OG-inf-0995-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0374117000. 1.26. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-09962022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.27. Consta el oficio SINAC-ACC-OG-inf-0996-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0374122-000- 1.28. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-0997-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.29. Consta el oficio SINAC-ACC-OG-inf-0997-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0374121-000. 1.30. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo N O 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-0998-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.31. Consta el oficio SINAC-ACC-OG-inf-0998-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad NO 2-0208376-000. 1.32. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-0999-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.33. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-1000-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.35. Consta el oficio SINAC-ACC-OG-inf-1000-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-444352-000. 1.36. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-1001-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.37. Consta el oficio SINAC-ACC-OG-inf-1001-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-198718-000. 1.38. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-1002-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.39. Consta el oficio SINAC-ACC-OG-inf-1002-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-437300-000. 1.40. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-1003-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.41. Consta el oficio SINAC-ACC-OG-inf-1003-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-329640-000. 1.42. Con fecha 21 de octubre del 2022, el Ing. Joseph Antonio Acuña Cruz, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACCOG-inf-1004-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.43, Consta el oficio SINAC-ACC-OG-inf-1004-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0377648-000”. (Informe de la autoridad recurrida). d) El 19 de octubre de 2022, la autoridad recurrida fue notificada del curso de este amparo. (Acta de notificación). III.- Sobre el caso concreto. En el sub lite, el accionante interpone recurso de amparo contra el SINAC. Indica que el 25 de abril de 2022 planteó una denuncia por la supuesta invasión constructiva de más de 100 viviendas, en la que pidió que se le comunicaran los actos que llevara a cabo el SINAC; sin embargo, no ha recibido copia del informe de la investigación. Aduce que el 5 de setiembre de 2022 hizo solicitud de información, pero al 26 de ese mes no le habían contestado. Pide que se declare con lugar el recurso y se ordene entregarle copia del informe final de la investigación. Del estudio de los autos se tiene por demostrado, que el 25 de abril de 2022, la oficina subregional de Grecia del SINAC recibió un escrito del recurrente con el siguiente contenido: “(…) presento la siguiente DENUNCIA FORMAL, contra la Municipalidad de Grecia, esta como ente rector que otorga los permisos contructivos (sic), y que tiene la responsabilidad de vigilar y proteger tanto las leyes y reglamentos, así como el Plan Regulador Urbano. Motivo de la denuncia: Por haber otorgado permisos contructivos (sic) en Zonas de protección de la Naciente El Patal, y Naciente La Amelia. Ley 7575 artículo 33. (…) Dicho lo anterior, manifiesto que se investigue en las siguientes fincas si existen construcciones dentro de la zona de protección de la Naciente El Patal. 435343- 329640- 322583- 336612- 437300- 444351-455220-386554- 208376- 555189- 565152- 198718. Y la Finca No. 2850 misma corresponde a Centro Comercial Plaza. Tomando como punto de referencia las coordenadas, HOJA DE NARANJO, LATITUD 229.081 LONGITUD 501-291 NACIENTE EL PATAL, PROPIEDAD DE EL PATAL S.R.L Segun (sic) expediente No.6518 del 24 de Marzo de 2017 dice que la misma es captada para consumo humano poblacional. Por lo que la Ley 7575 art 33 su radio de protección es de 200 mts. Por lo que pido, que se haga la investigación en el radio de los 200 metros, ya que el Oficio No.GAJ-043-2022 del 22 de Abril de 2022 me responde con un radio de 100 metros. Solicito también se amplíe la investigación, en las siguientes coordenadas: LATITUD 229.520 LONGITUD 502. 465 NACIENTE LA AMELIA, PROPIEDAD MUNICIPAL. Según expediente No 6518 del 24 de Marzo de 2017, el mismo dice que es captada para consumo humano poblacional, pido que la investigación se apliquen a cabalidad la Ley No. 7575 artículo 33. los 200 mts ya (sic) es captada para consumo humano poblacional. Ante tal preocupación, remito la presente y solicito ante usted: 1.- Que se valore esta DENUNCIA FORMAL y se haga lo correspondiente conforme a derecho. 2.- Que se me notifique de todos los actos que de ahora en adelante realice el Sinac Oficina de Grecia, con respecto a esta denuncia (…) notificaciones al correo electrónico [email protected]”. El 27 de setiembre de 2022, la oficina subregional de Grecia del SINAC envió al correo electrónico [email protected] la siguiente información: “Sr [Nombre 001] Estimado Le informo que, en la atención de una queja interpuesta por su persona por aparentes invasiones a áreas de protección de nacientes de conformidad con la Ley Forestal 7575, fue acogida y tramitada con el SITADA: 36465-2022 y durante dicha investigación se obtuvo: Que, durante las inspecciones realizadas en campo y análisis mediante Sistemas de información Geográfica se concluye que: Dentro del área de protección de la naciente con dictamen: DA-UHTPCOSJ-0026-2018 (El patal) se encuentran las siguientes fincas: 1. Finca 374116 existe una construcción de 191 metros cuadrados entre los 82 y 99 metros de distancia de la naciente. 2. Finca 374117 existe una construcción de 115 metros cuadrados entre los 89 y 99 metros de distancia de la naciente. 3. Finca 208376 existe una construcción de 106 metros cuadrados entre los 77 y 90 metros de distancia de la naciente. 4. Finca 374122 existe una construcción de 176 metros cuadrados entre los 89 y 99 metros de distancia de la naciente. 5. Finca 374121 existe una construcción de 125 metros cuadrados entre los 88 y 100 metros de distancia de la naciente 6. Finca 377648 existe una construcción de 24 metros cuadrados entre los 95 y 100 metros de distancia de la naciente. Dentro del área de protección de la naciente con dictamen: DA-UHTPCOSR-0099-2020 (sin nombre) se encuentran las fincas: 1. Finca 198718 existen cultivos y remoción de capa vegetal de aproximadamente 6893 metros cuadrados entre los 21 y 99 metros de distancia de la naciente. 2. Finca 322583 existe una construcción de 100 metros cuadrados entre los 88 y 99 metros de distancia de la naciente. 3. Finca 437300 existe una construcción de 206 metros cuadrados entre los 79 y 82 metros de distancia de la naciente. 4. Finca 329640 existe una construcción de 292 metros cuadrados entre los 97 y 99 metros de distancia de la naciente. 5. Finca 444352 existe una construcción de 140 metros cuadrados entre los 82 y 95 metros de distancia de la naciente. 6. Finca 208376 existe una construcción de 98 metros cuadrados entre los 74 y 88 metros de distancia de la naciente. Dentro del área de protección de la naciente con dictamen: AT-0025-2012 (Amelia) se encuentran las fincas: 1.Finca 198374 existen cultivos y remoción de capa vegetal de aproximadamente 7162 metros cuadrados entre los 18 y 99 metros de distancia de la naciente. 2. Finca 316549 existe una construcción de 274 metros cuadrados entre los 75 y 96 metros de distancia de la naciente. 3. Finca 316547 existe una construcción de 151 metros cuadrados entre los 68 y 89 metros de distancia de la naciente. 4. Finca 331441 existe una construcción de 72 metros cuadrados entre los 70 y 91 metros de distancia de la naciente 5. Finca 368553 existe una construcción de 80 metros cuadrados entre los 81 y 94 metros de distancia de la naciente. 6. Finca 333151 existe una construcción de 141 metros cuadrados entre los 85 y 98 metros de distancia de la naciente. 7. Finca 249766 existe un muro con un área de 100 metros cuadrados aproximados entre los 43 y 93 metros de distancia de la naciente. 8. Finca 230033 existe una construcción de 99 metros cuadrados entre los 09 y 20 metros de distancia de la naciente. Por tanto, Ley Forestal Nº 7575, artículo 33 por encontrarse lo anterior citado dentro del radio de los 100 metros de protección se confeccionaron los informes de hechos correspondientes con los oficios SINAC-ACC-OG-inf-880-2022, SINAC-ACC-OG-inf882-2022, SINAC-ACC-OG-inf-883-2022 y SINAC-ACC-OG-inf-886-2022. Dado la amplitud de la investigación y el análisis requerido y que dichas estructuras no son recientes, están pendientes de información aun (sic) de algunas fincas con respecto a los permisos municipales y cuando fueron construidos, así como las respectivas direcciones funcionales, dicha información será remitida para adenda de los casos al Organismo de Investigación Judicial, para una mejor resolución de los hechos encontrados”. El jefe de la oficina subregional de Grecia del SINAC informó que se llevaron a cabo las siguientes diligencias en atención a la denuncia planteada por el accionante: “1.1. En atención a la denuncia ambiental con consecutivo Nº 36465-2022 del Sistema integrado de Trámite y Atención de Denuncias Ambientales (SITADA), la oficina subregional del SINAC de Grecia realizó una serie de gestiones de investigación (análisis geográfico de la zona, consultas a la municipalidad de Grecia, entre otras), entre las cuales, se realizaron inspecciones de campo en el mes de agosto a las propiedades denunciadas, con el fin de verificar los hechos denunciados, de estas inspecciones se generaron los siguientes informes de hechos: SINAC-ACC-OG-inf-0985-2022, SINAC-ACC-OG-inf-0986-2022, SINAC- ACC-OG-inf-0987-2022, SINAC-ACC-OG-inf-0988-2022, SINAC- ACC-OG-inf-0989-2022, SINAC-ACC-OG-inf-0990-2022; SINAC- ACC-OG-inf-0991-2022, SINAC-ACC-OG-inf-0992-2022, SINAC- ACC-OG-inf-0994-2022, SINAC-ACC-OG-inf-0995-2022; SINAC- ACC-OG-inf-0996-2022; SINAC-ACC-OG-inf-0997-2022, SINAC- ACC-OG-inf-0998-2022, SINAC-ACC-OG-inf-0999-2022, SINAC- ACC-OG-inf-1000-2022, SINAC-ACC-OG-inf-1001-2022, SINAC- ACC-OG-inf-1002-2022, SINAC-ACC-OG-inf-1003-2022, SINAC- ACC-OG-inf-1004-2022. . 1.2. Con fecha 27 de setiembre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, envía correo electrónico al Sr. Manuel Segura, funcionario de la Municipalidad de Grecia en el cual, le solicita información sobre la existencia de permisos municipales, ampliaciones, movimientos de tierra u otros con respecto a las fincas Nº : 374116, 374117, 208376, 374122, 374121, 377648, 198718, 322583, 437300, 329640, 4444352, 208376, 198374, 316549, 316547, 331441, 368553, 333151, 249766 y 230033; por encontrase toda ellas, invadiendo áreas de protección y en atención a la denuncia ambiental con consecutivo Nº 364652022 del SITADA. 1.3. Con fecha 10 de octubre del 2022 la Sra. Yorleny Abarca Bogarín funcionaria de la municipalidad de Grecia, hace llegar a la oficina subregional del SINAC de Grecia vía correo electrónico el oficio IM-6938-2022, en el cual, se brinda información en atención a la solicitud hecha el 27 de setiembre del 2022, por el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia. 1.4. Con fecha 13 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, realiza dirección función vía correo electrónico al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, en la cual, le solicita criterio sobre las gestiones que se están realizando en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA). 1.5. Con fecha 19 de octubre del 2022, el Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, responde la dirección funcional realizada a su persona el 13 de octubre del 2022 por parte del Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia. 1.6. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-09852022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.7. Consta el oficio SINAC-ACC-OG-inf-0985-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0198374-000. 1.8. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-0986-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.9. Consta el oficio SINAC-ACC-OG-inf-0986-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0316549000. 1.10. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACCOG-inf-0987-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.11. Consta el oficio SINAC-ACC-OG-inf-0987-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0316547-000. 1.12. Con fecha 21 de octubre del 2022, el Ing. Maikol Rodríguez Gómez, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Consta el oficio SINAC-ACC-OG-inf-0997-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0374121-000. 1.30. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo N O 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-0998-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.31. Consta el oficio SINAC-ACC-OG-inf-0998-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0208376-000. 1.32. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-0999-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.33. Consta el oficio SINAC-ACC-OG-inf-0999-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0322583-000. 1.34. Consta el oficio SINAC-ACC-OG-inf-1000-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-444352-000. 1.36. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-1001-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.37. Consta el oficio SINAC-ACC-OG-inf-1001-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-198718-000. 1.38. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-1002-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.39. Consta el oficio SINAC-ACC-OG-inf-1002-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-437300-000. 1.40. Con fecha 21 de octubre del 2022, el Sr. Cecilio Chacón Soto, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACC-OG-inf-1003-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.41. Consta el oficio SINAC-ACC-OG-inf-1003-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-329640-000. 1.42. Con fecha 21 de octubre del 2022, el Ing. Joseph Antonio Acuña Cruz, funcionario de la oficina subregional del SINAC de Grecia, en seguimiento a la Dirección Funcional realizada al Lic. Alejandro Alpízar Arrones, funcionario de la Fiscalía Adjunta Agrario Ambiental, y en atención a la denuncia ambiental con consecutivo Nº 36465-2022 (SITADA), realiza traslado del informe de hechos con oficio SINAC-ACCOG-inf-1004-2022, vía correo electrónico ([email protected]), al Organismo de Investigación Judicial de Grecia, para que se realicen las investigaciones pertinentes. 1.43, Consta el oficio SINAC-ACC-OG-inf-1004-2022, con el cual, se traslada al Organismo de Investigación Judicial, informe de hechos respecto de la propiedad Nº 2-0377648-000”. El 19 de octubre de 2022, la autoridad recurrida fue notificada del curso de este amparo. Desde este panorama, en los términos planteados en el escrito de interposición, se descarta alguna situación que, en este momento, amerite la intervención de la Sala. Al respecto, del informe rendido bajo juramento se desprende que, el 27 de setiembre de 2022, la autoridad recurrida le envió un correo electrónico al accionante con los resultados de la investigación hasta ese momento. Precisamente, en aquella oportunidad se le indicó que el SINAC llevó a cabo inspecciones de campo y determinó la existencia de construcciones dentro de áreas de protección de nacientes en al menos 20 propiedades; además, se le expuso que estaban pendientes algunas averiguaciones de varias fincas con respecto a los permisos municipales y las fechas de las construcciones, así como que la información iba a ser enviada al Organismo de Investigación Judicial. Es decir, dos días antes de la interposición de este recurso (29 de setiembre de 2022) se le comunicó el estado de la denuncia. En adición, consta en el expediente que, el 27 de setiembre de 2022, el órgano accionado hizo un requerimiento de información a la Municipalidad de Grecia, el cual fue contestado el 13 de octubre siguiente. Este último día, el SINAC pidió dirección a la Fiscalía Adjunta Agrario Ambiental, la cual el respondió el 19 de ese mes. Finalmente, se aprecia que el 21 de octubre de 2022, la autoridad recurrida envió 19 oficios al Organismo de Investigación Judicial Ahora, el accionante acusa concretamente que no se le ha entregado copia del informe de la investigación y que tampoco se atendió la solicitud de información que hizo el 5 de setiembre de 2022. En cuanto al primer extremo, el recurrente no menciona la fecha en la cual solicitó la entrega de la fotocopia de ese documento, por lo que, como no hace referencia a una situación individualizada, a priori no se puede analizar la constitucionalidad de tal alegato general y abstracto. En relación con la presunta solicitud de información de 5 de setiembre no solo no la aportó como prueba, sino que no precisó específicamente su contenido. Nótese que, previo a dar curso al presente amparo, la Presidencia de la Sala le previno aportar copia de la solicitud de información; empero, no cumplió tal prevención. En consecuencia, el segundo alegato también debe desestimar. Con base en las consideraciones expuestas, se declara sin lugar el recurso. IV.- Documentación aportada al expediente . Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documento, ya sea en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI. Por tanto: Se declara sin lugar el recurso.
