Constitutional protection proceeding (recurso de amparo) processed under expediente n.° 22-015651-0007-CO, filed by [Nombre 001], identity card [Valor 001], [Nombre 002], identity card [Valor 002], [Nombre 003], identity card [Valor 003], [Nombre 004], identity card [Valor 004], [Nombre 005], identity card [Valor 005], [Nombre 006], identity card [Valor 006], and [Nombre 007], identity card [Valor 007], against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA) and the MINISTERIO DE SALUD.
Findings of Fact:
FIRST: It is not true that contamination by agrochemicals (contaminación por agroquímicos) has ever been formally acknowledged by the institutional entity competent for that purpose. The analyses conducted by the Laboratorio Nacional De Aguas, including for chlorothalonil (Clorotalonil), have not detected their presence. In the case of the analyses conducted by the Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional IRET-UNA, which state that certain metabolites (metabolitos) were detected, the information has been used as a basis for focusing efforts, but those analyses are not accredited and, as IRET itself notes, have not been fully validated; therefore, they cannot be regarded as conclusive. The analyses used to determine the potability of the water (potabilidad del agua) must be accredited, as required by Article 10 of the Reglamento para la Calidad del Agua Potable 38924-S and Article 34 of the Ley del Sistema Nacional de Calidad N° 8279.
In this case, it must be clarified that the opinion issued by the Oficina Regional Central Este was for internal purposes and does not represent the Institution’s position or an acknowledgment of water contamination. What it states is that, according to the analyses conducted by IRET-UNA, certain parameters appear to be altered, and it requests assistance in coordinating with the Laboratorio Nacional de Aguas and other units within the Institution. This opinion was provided for the purpose of generating an institutional discussion so that the necessary technical assessments could be conducted to define a course of action for addressing the case in light of the analyses conducted by IRET-UNA. Regarding this matter, it was determined that the analyses detecting metabolites of the pesticide chlorothalonil could not be deemed valid, based on the opinion of the Laboratorio Nacional de Aguas, which is the entity within the Institution competent in matters concerning drinking-water quality parameters (parámetros de calidad de agua potable).
SECOND: In the case of the analyses conducted by IRET, which state that certain metabolites were detected, the information has been used as a basis for focusing institutional efforts. However, these analyses are not accredited and, as IRET itself notes, have not been fully validated; therefore, they cannot be regarded as conclusive. It is important to recall that the analyses used to issue an opinion on water quality (calidad del agua) must be accredited, as required by Article 10 of the Reglamento para la Calidad del Agua Potable 38924-S and Article 34 of the Ley del Sistema Nacional de Calidad N° 8279.
THIRD: This is not true. With regard to the measures taken, once the Oficina Regional Central Este received by email on March 7, from the Ministerio de Salud de Oreamuno, the results of the analyses conducted by IRET, it issued a request for an opinion and a warning concerning the potential presence of these compounds. In response to the Regional Office’s inquiry, the unit within the Institution competent to determine water potability, the Laboratorio Nacional de Aguas, issued official letter (oficio) PRE-LNA-2022-00193 (Annex 1), which states that the results in question cannot be regarded as conclusive because the analytical method (método de análisis) is not accredited. Accordingly, the water is not considered contaminated with chlorothalonil metabolites. Nevertheless, the Institution continues its efforts to collaborate with a laboratory in Costa Rica or abroad in order to determine, on a scientific basis and in compliance with the regulations applicable to the matter, whether chlorothalonil metabolites are present.
FOURTH: It is true that the request was submitted. However, the Institution has a procedure for addressing cases involving impairment of water quality (afectación de calidad de agua), under which the Laboratorio Nacional De Aguas must diagnose the situation and confirm the reported contamination. In this case, according to the opinion issued by the Laboratorio Nacional de Aguas in official letter PRE-LNA-2022-00193 (Annex 1), the contamination detected by the Laboratorio del Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional (IRET-UNA) cannot be confirmed. In light of the opinion cited above, it is not possible to issue a declaration of contamination (declaratoria de contaminación), which is the starting point for activating the contamination protocol (Protocolo de contaminación), the protocol for distributing drinking water by tanker trucks (Protocolo para distribución de agua potable mediante camiones cisterna), and the social-intervention strategy for assisting communities affected by contamination events involving drinking-water sources (Estrategia de intervención social para la atención de las comunidades afectadas por eventos de contaminación de fuentes de agua potable).
It is not true that drinking water must be supplied by tanker trucks to the community served by the ASADA Cipreses de Oreamuno, because the institutional procedure requires confirmation from the Laboratorio Nacional de Aguas before the protocol for distributing drinking water by tanker trucks may be activated. With regard to protection areas (áreas de Protección), the ASADA is currently in the process of conducting comprehensive hydrogeological studies (estudios hidrogeológicos integrales) and hydrogeological studies of protection areas (estudios hidrogeológicos de áreas de protección), which will provide valuable data for exercising effective oversight of those areas. The Ministerio de Salud has issued health orders (órdenes sanitarias) to the farmers who were within the protection area.
FIFTH: This is not true, because it cannot be asserted that the Laboratorio Nacional De Aguas failed to address chlorothalonil degradation by-products (subproductos de degradación del Clorotalonil), given that an opinion exists (PRE-LNA-2022-00193) specifying that these analyses cannot be regarded as conclusive because they do not satisfy the requirements concerning accreditation of the method, as required by the regulations cited above. The Institution did not report these metabolites directly because the Laboratorio Nacional De Aguas analyzed the pesticides for which it is accredited, including chlorothalonil. Those analyses yielded negative results for the presence of the pesticides tested and met the regulation’s other parameters; therefore, the analyses conducted were found to comply with the regulation. The metabolites mentioned are not included within the accredited scope (alcance acreditado) of the Laboratorio Nacional De Aguas Del AyA, and the Institution has not been provided with any accredited analysis demonstrating the presence of these metabolites.
In view of the foregoing concerning accreditation of the analytical method, the Laboratorio Nacional De Aguas cannot scientifically declare that contamination exists, given that IRET’s results may be treated only as an alert and not as conclusive data. The data generated by IRET have not been refuted by AyA, but no definitive opinion can be issued regarding them because they were generated using a method that had not been fully validated, as IRET itself states, and these analyses are not accredited, as required by the applicable regulations. In this regard, the Institution, through the Laboratorio Nacional de Aguas, has taken steps to request the procurement of the supplies needed to expand its analytical scope (alcance analítico) to cover the metabolites involved in this case. This entails procuring supplies that are unavailable in the country and must undergo the administrative procurement process (proceso de contratación administrativa), as well as potentially requiring requests for budget amendments (modificaciones presupuestarias).
In the case of pesticides registered with the Servicio Fitosanitario del Estado, this list is constantly changing because new molecules are continually being registered. Including all registered pesticides within the scope would require a substantial amount of work over several years, without taking into account how the registered molecules change over time. It is important to clarify that level N4 does not define a pre-established list of pesticides and corresponds specifically to whatever the Ministerio de Salud requires at a given time; in other words, there is no N4 pesticide list, and the list generated by MINSA for each specific case is essentially unlimited.
SIXTH: It is not true that the water sources (fuentes de agua) are not being protected. Efforts are currently under way to correct and obtain approval of the hydrogeological studies of the springs (nacientes) in question; health orders have been issued to the landowners who were planting crops within the protection area; and the aqueduct (acueducto) participates in the Programa Sello de Calidad Sanitaria del Laboratorio Nacional De Aguas, which ensures that analyses are being conducted to determine water potability, together with an assessment of the risk factors relating to the condition of the protection areas. In this regard, the Oficina Regional Central Este, in coordination with the ASADA, will conduct periodic visits to inspect the protection areas, and if alterations are detected, it will notify the Ministerio de Salud so that it may take the appropriate measures. It is incorrect to state that no action has been taken to protect the water.
In addition to the processes described in FACT EIGHTH, the Subgerencia de Gestión de Sistemas Delegados formulated a Water Safety Plan (Plan de Seguridad del Agua) (Annex 2) to address the identified problem and take specific mitigation measures (acciones puntuales de mitigación). The objective of the Action Plan (Plan de Acción) is to design and implement a Comprehensive Risk Management System (Sistema Integral Gestión del Riesgo) for the ASADA de Cipreses de Oreamuno and thereby identify and assess risks throughout the service-delivery process, so that measures may be defined to mitigate them. For this purpose, the Subgerencia de Gestión de Sistemas Delegados will collaborate and provide methodological support for the development and implementation of the Plan de Seguridad del Agua (PSA), based on the institutional methodology.
SEVENTH: According to the opinion issued by the Laboratorio Nacional De Aguas, the relevant analyses must be accredited. This institutional unit currently has an accredited method for chlorothalonil, but not for chlorothalonil metabolites, and it does not presently have the resources to implement the technique. Despite a search of laboratories with accredited scopes in Costa Rica, the United States, and several European countries, it has not been possible to find a laboratory with these analyses accredited under the INTE-ISO/IEC 17025:2017 standard or an equivalent standard, as required by Costa Rican law. The search will continue until a means is available to conduct analyses capable of determining whether contamination exists. It cannot be established that the population of Cipreses de Oreamuno is consuming contaminated water, because it has not been technically possible to determine whether the water at the Plantón and Carlos Calvo springs is being affected by pesticide residues (residuos de plaguicidas), nor has it been possible to quantify chlorothalonil metabolites through a laboratory whose analytical method is accredited, according to the opinion of the Laboratorio Nacional De Aguas.
Therefore, additional analyses must be conducted in order to apply the contamination protocol that would support taking actions such as the possible closure of the source for human consumption and the distribution of water by tanker trucks, in accordance with Institutional procedures. EIGHTH: It is true that, pursuant to the Ley de aguas, the 200 m protection area (área de protección) must be preserved; for this reason, the Reglamento de ASADAS, in Article 42, subsection f), provides: “f. Protection Area: To the extent possible, the ASADA shall delimit the protection areas of its water-supply sources in accordance with current legislation and shall endeavor, as a priority, to acquire and undertake conservation and protection measures for those areas. To determine protection areas, it must first request a technical opinion from AyA, as provided in the Ley General de la Administración Pública and Article 2, subsection c), of the Ley Constitutiva del AyA.” Regarding the protection of springs (nacientes), the hydrogeological studies (estudios hidrogeológicos) for the Plantón, Carlos Calvo, and Edwin Coto springs (the latter being out of use) are currently under review by the UEN Gestión Ambiental del AyA.
Special follow-up is being conducted so that the consultants hired by the ASADA can correct the reports submitted to AyA, because, to date, these technical materials do not meet the requirements of this Institutional department. In addition, the ASADA has requested that the UEN Gestión Ambiental del AyA conduct a hydrogeological study to delimit the special protection area of the Carlos Calvo and Plantón springs. In response, the operating entity is assembling the requirements, including authorization from the property owners for AyA hydrogeologists to enter their properties and conduct the corresponding analyses. The Ministerio de Salud has issued sanitary orders to the property owners who were carrying out agricultural activities near the Plantón spring; therefore, restrictive measures have already been implemented by other State Institutions in support of managing the potential contamination case.
Once the corrected studies have been approved by the UEN Gestión Ambiental and the hydrogeological behavior of the springs, the recharge zone (zona de recarga), and the protection zone (zona de protección) have been determined, specific measures may be taken for the comprehensive management and protection of the water resource (recurso hídrico) and the areas of forest cover (cobertura boscosa) required to maintain its quantity and quality, thereby permitting the full enjoyment of the constitutional right to drinking water. NINTH: Based on the scientific evidence presented internationally regarding the pesticide chlorothalonil, the Institution has opened an internal discussion on this matter to formulate an opinion that will subsequently enable the authorities of the Ministerio de Salud and the Ministerio de Agricultura y Ganadería, together with other input, to decide whether this pesticide should be prohibited in the Country, following criteria aimed at protecting public health.
To determine whether the springs administered by the ASADA Cipreses de Oreamuno are contaminated, analyses using accredited methods are required, as explained above. The Institution is committed to finding a way to confirm the presence of these degradation-product compounds in the water supplied to the population or, alternatively, to rule out the existence of these compounds in the supply system administered by the ASADA Cipreses de Oreamuno (…)”.
FIRST: I appear before your Authority for the purpose of submitting an active intervention in support (coadyuvancia activa) in this amparo proceeding (amparo), based on the broad standing (legitimación amplia) arising from constitutional provisions 21 and 50, as linked to diffuse interests (intereses difusos).
SECOND: I consider this to be a case in which the violations of the in dubio pro aqua principle (principio induvio pro aqua), the in dubio pro natura principle (principio induvio pro natura), the precautionary principle (principio precautorio), and the principle of scientific protection (principio de tutela científica) are typically evident. This is because, despite the doubts maintained by various government offices regarding the carcinogenic effects of agrochemicals, the Instituto Costarricense de Acueductos y Alcantarillados refuses to accept its responsibilities and take measures to find solutions concerning water analyses. This follows from a reading of the response issued to this Chamber by the respondent entity, as well as from the statements made by the UEN in official letter No. GSD-UEN-GAR-2022-02798 dated 18 de julio del 2022, which is included in the record. Note that the response given to the Chamber is more focused on defending agricultural business owners and the companies that bring agrochemicals into the country than on defending communities and ecosystems.
In official letter No. GSD-UEN-GAR-2022-02798, you will be able to read that various States have repeatedly identified the health damage caused by the agrochemical in question and its by-products; therefore, there can be no doubt that the amparo proceeding must be granted. Note that, in this case, the IRET/UNA laboratory identified the situation from the outset, as the respondents have acknowledged. In light of the foregoing, I consider that attempting to discredit and virtually disregard the findings concerning toxicity made by the academics’ laboratory would unquestionably be an error that violates environmental human rights, since UNCERTAINTY should favor the urgent adoption of measures. Also in this case, note that biodiversity is affected and contaminated, because the water emanating from the sources is also used by birds, insects, and other living beings, yet no one is discussing this; this violates the rationale of constitutional provision 50, which expressly refers to an ecologically balanced environment.
To date, although we are facing a problem detected several years ago, the studies needed to mitigate the contaminating effects on the water used by other living beings have not been conducted, and I request that this be so stated. Official letter No. GSD-UEN-GAR-2022-02798 states: “In December 2019, concerning this same issue, the Federal Office for Agriculture of the Swiss Confederation (Bundesamt für Landwirtschaft BLW, by its German name) decided to withdraw authorization for products containing the fungicide Chlorothalonil, given that in 2010 that country established a review of older agricultural products to ensure their compliance with current requirements, and it was determined that ‘The industry has provided new data from accredited laboratories concerning the toxicity of certain degradation products. Following the Federal Food Safety and Veterinary Office’s (FSVO) review of the additional data, it cannot be ruled out that certain degradation products of this fungicide may have a long-term adverse effect on health.
Furthermore, the FSVO agrees with the EU Commission’s assessment of Chlorothalonil that the substance should probably be classified as carcinogenic.’” (Emphasis added). Based on that alone, and applying analogy in defense of the environmental human rights involved, you should consider the critical situation in which even the related aquifer or aquifers may have been irreversibly damaged; worst of all, in the face of scientific and technical doubts, instead of accepting their responsibilities as required by the principle of objectification (principio de objetivación) and scientific protection, you can read that the ICAA respondents instead request that the amparo proceeding be denied. The UN report entitled “Human rights obligations relating to the enjoyment of a safe, clean, healthy and sustainable environment,” dated 15 de julio de 2020 and adopted at the Seventy-fifth session, states: “E.
Rights to water and sanitation. 47. Ecosystems are the source of all the water on which people depend. When water is polluted or overexploited, the right to adequate quantities of clean water is jeopardized. Sanitation systems throughout the world depend on ecosystems as an essential component of wastewater treatment, because ecosystems purify polluted water. 48. As South Africa stated: ‘Water is the lifeblood of South Africa. It affects the well-being of the country’s population, and water scarcity or declining water quality will hinder economic development and compromise basic human rights in the country. Water is intrinsically linked to the ecosystems through which it passes; ecosystem deterioration will adversely affect the quantity and quality of water. More than half of the ecosystems associated with our rivers and freshwater supply are seriously degraded.’” Therefore, when thinking in ecosystem terms, water must unquestionably be protected, since doing so benefits even future generations and, of course, ecosystems.
Along the same lines, the UN stated in that report: “B. Accelerating measures to protect and conserve nature. 86. The post-2020 global biodiversity framework must explicitly support a rights-based approach to achieving rapid and ambitious progress in the protection, conservation, and sustainable use of biological diversity. Scientists, civil society, and a growing number of States have endorsed the ambitious goal of protecting 30 % of the planet’s land and waters by 2030, which has led to its inclusion in the draft post-2020 framework. Although achieving that goal could yield enormous human-rights benefits by protecting nature’s contributions to people, the processes of identifying, designating, and managing other protected and conserved areas must be carried out in collaboration with Indigenous peoples and local communities in order to safeguard their rights. Protecting and restoring ecological connections between protected and conserved areas is also essential.” We therefore respectfully request that this amparo proceeding be granted as to all claims seeking to resolve a very serious problem involving water resources (recurso hídrico).
THIRD: As this Chamber will have observed, the situation is clearly critical, because it appears likely to continue for years due to existing institutional doubts, when those doubts should instead be resolved in favor of communities, clean water, and ecosystems. In this regard, note that the ICAA respondents state in their response that, based on one regulatory provision and one statutory provision, they cannot endorse the defense of human rights. That is, it appears that, in the respondents’ view, provision 10 of Reglamento para la Calidad del Agua Potable 38924-S and article 34 of Ley del Sistema Nacional de Calidad N°8279 take precedence over environmental human rights and the right recognized in our constitutional provision 50, which declares and recognizes the human right to water in sufficient quantity and quality. I consider that the respondents are not even applying a criterion of progressivity (criterio de progresividad) in defense of environmental human rights, and that is terrible and disappointing.
The Instituto Costarricense de Acueductos y Alcantarillados itself publicly acknowledged that it lacked the capacity to monitor contaminants in the communities’ water, as stated in official letter PRE-2022-00572, because it reported the inability of the Laboratorio Nacional de Aguas (LNA) when it stated: “ At present, neither the LNA nor any other laboratory in the country is accredited to conduct this study ….” We therefore see that the amparo proceeding must be granted and that the ICAA respondents must be ordered to modernize, allocate funds, and urgently purchase whatever must be purchased, since all of this is done in defense of fundamental rights. We have now exceeded planetary boundaries and cannot continue abusing the Earth. Professor Rafael González Ballar (2019)1 states, regarding the need to integrate everything through an ecobiocentric vision: “29 scientists led by Johan Rockström (publishing ‘Planetary Limits’ in 2009) discuss an important new concept: a safe operating space for humanity.
Human activities must take place within that safe space for humanity without running the risk or threat of exceeding the Earth system’s ecological thresholds… The last two decades have made it evident that risk and resilience have emerged as new concepts necessary for its regulations, as have, finally, the adaptations needed to make an Ecological State under the Rule of Law (Estado Ecológico de Derecho) a reality. For Environmental Law (Derecho Ambiental) to better fulfill its current mission, an evolution toward an Ecological State under the Rule of Law is necessary. We may conceive of it as a break with the traditional notion of the State. It entails an ideological change because, from an ethical standpoint, the environment becomes a priority in public policies and in the State’s conduct generally.” It is unacceptable to tell you that the ICAA is trying to find a laboratory or someone internationally who has what is needed, because it is not even known whether that is true, given that the respondents submit nothing in that regard, and it is evident that they are misleading you.
In light of the foregoing, we consider that, because environmental human rights are at issue, it is essential to grant the amparo proceeding, including by ordering the respondents to adapt the entire Laboratorio Nacional de Aguas to the current needs arising from the agrochemicals entering the country, as requested by the petitioners. This Chamber has previously ruled that institutional budgets CANNOT take precedence over human rights; therefore, the Laboratorio Nacional de Aguas must undergo a revolutionary transformation. Granting the petitioners’ requests will result in a structural judgment (sentencia estructural) defending water through a sustainable vision for the benefit of ecosystems and future generations.”.
“With respect to the allegations made by the appellant and others, insofar as they fall within the jurisdiction of the Área Rectora de Salud de Oreamuno, Ministerio de Salud, I hereby report as follows: Regarding point 1 alleged by MR. [Nombre 001] AND OTHERS, appellants, I report that the appellants’ assertion is entirely false and wholly untrue because, according to a review of the files of this Área Rectora de Salud, the technical report in question, MS-DRRSCE-DARSO-IT-00312-2021, was prepared on 13 de agosto del 2021 in connection with the follow-up concerning the handling of complaint [Valor 008]; therefore, as of that date, the presence of those degradation products of the pesticide chlorothalonil was unknown, since those results were not received by this Área Rectora de Salud until 21 de diciembre del 2021, through official letter 082-2021 signed by Mr. Virgilio Ulloa Ulloa, President of the ASADA de Cipreses.
(folios 01088 al 01094 = folios 00001 al 00007 y del 01213 al 01219 = folios 00008 al 00014) Regarding points 2 and 3, alleged by MR. [Nombre 001] AND OTHERS, appellants, the following is reported: Once again, the appellants’ assertion is entirely false and wholly untrue because, since 17 de diciembre del 2020, through Sanitary Order (Orden Sanitaria) CE-ARS-O-OS-4986-2020, Mr. Virgilio Ulloa Ulloa, President of the ASADA de Cipreses, had been ordered to conduct semiannual fourth-level analyses at the control Plantón Spring (Naciente Plantón de control), independently of the analyses that, by regulation, were required to be submitted semiannually (folio 00258 al 00260 = folios 00015 al 00016).
Furthermore, the report containing the results of the pesticide analyses was received by this Área Rectora de Salud on 21 de diciembre del 2021, and through technical report MSDRRSCE-DARSO-IT-00028-2022, support was requested from the Central Level, specifically from Dr. Albin Badilla Mora of the Ministerio de Salud’s Drinking Water Monitoring and Control unit, so that the issue and the next steps concerning these degradation products of the fungicide chlorothalonil detected in the ASADA de Cipreses water-supply system (acueducto) could be clarified for us (folios 01239 al 01240 = folios 00017 al 00018).
On 07 de marzo del 2022, according to official letter MS-DRRSCEDARSO-00181-2022, Mr. Virgilio Ulloa Ulloa, legal representative of the ASADA de Cipreses, was requested to include, in the upcoming pesticide sampling, analyses at the distribution-network level in order to determine their extent and obtain accurate information for the entire system. He was advised that the presence of degradation products had also been detected at the Carlos Calvo Spring (Naciente Carlos Calvo), and therefore sampling in that system must continue and must also include the distribution network. In addition, within 10 business days, he was required to submit the definitive short-term measures that the ASADA de Cipreses would take to guarantee the supplied population safe, quality water fit for human consumption (folios 01416 al 01420 = folios 00019 al 00020).
On 14 de marzo del 2022, according to official letter MSDRRSCE-DARSO-00214-2022, Dr. Oscar Bermúdez García, Regional Director of the Dirección Regional de Rectoría de la Salud Central Este, was informed of the results of the pesticide-residue analysis conducted at the two springs of the ASADA de Cipreses, and the assistance of Dr. Albin Badilla Mora, a Central-Level Ministerio de Salud official and expert in drinking-water control, was requested so that he could indicate the course of action to be followed in this case (folios 01442 y 01443 = folios 00021 al 00022).
On 16 de marzo del 2022, according to technical report MS-DRRSCE-DARSO-IT-0105-2022, for the purpose of verifying the physical and sanitary conditions of the ASADA de Cipreses water-supply system and in accordance with the provisions of the Reglamento de la Calidad del Agua Potable Decreto Ejecutivo N°38924-S and its amendments, the Drinking Water Quality Inspection Guidelines—SERSA were applied to the two systems operated by that ASADA. Certain irregularities were detected at the springs and storage tanks, and Mr. Virgilio Ulloa Ulloa was therefore requested to submit a remediation plan (plan remedial) setting out the corrective actions to be taken to remedy the deficiencies detected through application of the aforementioned guidelines (folios 01460 al 01461 = folios 00023 al 00024).
On 31 de marzo del 2022, in response to the request for assistance made by Dr. Oscar Bermúdez García to Dr. Albin Badilla Mora, a Central-Level Ministerio de Salud drinking-water expert, the first virtual meeting was held, during which all the problems affecting the ASADA de Cipreses were described. As a result of the full explanation, Dr. Badilla Mora decided to sample the springs and distribution network of that water-supply system (folio 01535 = folio 00025 y de los folios 01582 al 01583 = folios 00026 al 00027).
On 04 de abril del 2022, through technical report MS-DRRSCE-DARSO-IT-00124-2022, an update was provided on the actions taken in following up on the handling of complaint [Valor 008] concerning ASADA Cipreses. The report recommended issuing a sanitary order to Mr. Virgilio Ulloa Ulloa, President of the ASADA de Cipreses, requiring him to proceed immediately with demarcating the protection zone (zona de protección) of the Plantón Spring and Carlos Calvo Spring, and notifying the owners of the surrounding properties who had not yet been notified, as stipulated by Ley de Aguas N° 276, with respect to the Plantón Spring and the owners of the properties surrounding the Carlos Calvo Spring (folios 01596 al 01610= folios 00028 al 00042).
On 06 de abril del 2022, according to technical report CE-DRRSCEDARSO-IT-00280-2022, Dr. Albin Badilla Mora sampled the Plantón and Carlos Calvo Springs and the distribution network of the ASADA de Cipreses in order to assess the presence of pesticides (folios 01621 y 01622 = folios 00043 al 00044).
On 26 de abril del 2022, an email signed by Dr. Albin Badilla Mora was received, through which he provided a copy of the laboratory results for the analyses performed by the Laboratorio Nacional de Aguas on the springs of the ASADA de Cipreses (folios 01679 al 01684 = folios 00045 al 00050).
On 28 de abril del 2022, notice was received of official letter MS-DPRSA-USA-679-2022, signed by Engineer Ricardo Morales Vargas, Head of the Unidad de Salud Ambiental—DPRSA, and by Dr. Albin Badilla Mora of Drinking Water Monitoring and Control, both from the Central Level of the Ministerio de Salud. The letter referred to the report and results of the analyses conducted on the ASADA de Cipreses, stating verbatim:
“…the pesticide chlorothalonil was not detected in the samples collected at the ASADA de Cipreses, either for the Plantón System or for the Carlos Calvo System. It is important to emphasize that this analysis was conducted at a laboratory accredited within the scope of standard INTE-ISO/IEC 17025:2017, as established by Reglamento N°38924-S…” [sic], “… In addition to the results obtained by Laboratorio Chemlabs, the administrator of the ASADA de Cipreses advised that the Laboratorio Nacional de Aguas had conducted pesticide sampling in the water-supply system, and therefore the appropriate coordination was undertaken with the laboratory’s management to obtain the results, which are attached to this report under the name AyA-ID 2201277-01 Cipreses de Oreamuno. No pesticides were detected in these discrete analyses conducted at the springs of both systems, nor was chlorothalonil detected…” [sic].
(folios 01694 al 01702 = folios 00051 al 00059).
On 29 de abril del 2022, Sanitary Order CE-DRRSCE-DARSOOS-00037-2022 was served on Mr. Virgilio Ulloa Ulloa, President of the ASADA de Cipreses. He was ordered to keep water-supply system personnel involved in monitoring and controlling the boundaries of the springs; to continue the necessary steps to obtain a hydrogeological study (estudio hidrogeológico) of the area in order to secure scientific evidence for adopting measures that would provide greater protection of the water resource and ensure its availability; and to conduct pesticide analyses (N4) in Julio del año 2022, including chlorothalonil, at the Plantón and Carlos Calvo Springs through a laboratory whose testing methods are accredited. The foregoing was required pursuant to artículo 10 of Decreto N° 38924-S, Reglamento para la Calidad del Agua Potable y sus Reformas, and the results were to be submitted to the Área Rectora de Salud de Oreamuno, in accordance with the recommendations issued through official letter MS-DPRSA-USA-679-2022 (folios 01706 al 01707 = folios 00060 al 00061).
Through an email dated 04 de mayo del 2022, Dr. Albin Badilla Mora coordinated between the Ministerio de Salud and the Laboratorio Nacional de Aguas regarding the review of the ASADA de Cipreses case, in which an alert had been issued concerning contamination by products derived from chlorothalonil (folio 01734 = folio 00062).
On 04 de mayo del 2022, official letter MS-DRRSCE-URS-0131-2022, signed by Engineer Nelson Artavia Vega of the Proceso de Regulación de la Salud, Unidad de Rectoría de la Región Central Este, was received by email. It followed up on the case involving pesticide contamination in the ASADA Cipreses water-supply system in response to the request for assistance made by this Área Rectora de Salud. The letter issued a series of recommendations, notably that Mr. Virgilio Ulloa Ulloa be required, by administrative act (acto administrativo), to submit to this Área Rectora de Salud the results and analysis of the hydrogeological study of the Plantón and Carlos Calvo Springs conducted by Acueductos y Alcantarillados, which were delivered to that agency with the corrections requested by Geologist Christian Delgado Segura of the Dirección Área Funcional de Hidrogeología UEN, Gestión Ambiental, Acueductos y Alcantarillados, on 10 de febrero del año en curso.
As a preventive measure, he must also maintain surveillance of the protection zones of the Plantón and Carlos Calvo Springs, which are currently used by the water-supply system, to ensure that those zones are respected, and must notify this Área Rectora de Salud quarterly of the results of the inspections conducted to guarantee protection of the areas. If any encroachment (invasión) into the protection zones is detected, he must immediately report it to the appropriate institutions for such action as may be deemed appropriate (folios 01735 al 01740 = folios 00063 al 00068).” On 06 de mayo del 2022, the Virtual Meeting Log concerning the ASADA de Cipreses – Case Review – Chlorothalonil, with the participation of the three Management Levels of the Ministerio de Salud and the Laboratorio Nacional de Aguas, recorded a discussion of the problem arising from the lack of a laboratory in the country capable of testing for those metabolites, a situation that makes such testing impossible.
It was therefore agreed to schedule a new meeting with the additional participation of the Laboratorio de Análisis de Residuos de Plaguicidas (LAREP) and the Oficina Regional de Acueductos y Alcantarillados Central Este (folio 01748 = folio 00069). On 13 de mayo del 2022, the aforementioned Virtual Meeting Log recorded that Mr. Clemens Ruepert discussed the findings identified in the samples collected at the ASADA de Cipreses and the methods used, stating that he expected there would be greater clarity regarding validation of the method at a later date. Accordingly, Dr. Albin Badilla Mora stated that inter-institutional coordination was extremely important to strengthen the actions being taken, because there was an alert concerning Chlorothalonil, but further testing was required to validate the method, validate the matrix, and establish with certainty the concentrations and quantities detected.
It was agreed to hold another virtual meeting with the Ministerio de Salud and Acueductos y Alcantarillados and to request a technical opinion (criterio técnico) from the Laboratorio Nacional de Aguas regarding the ASADA de Cipreses case (folio 01752 = folio 00070). On 27 de mayo del 2022, through official letter MS-DPRSA-USA-907-2022, Dr. Albin Badilla Mora requested an opinion regarding the ASADA Cipreses case from Eng. David Cambronero Bolaños of the Laboratorio Nacional de Aguas, as a follow-up to the agreements reached at the aforementioned meeting (folios 01763 al 01764 =folios 00071 al 00072). On 03 de junio del 2022, through ministerial directive MS-DM-5043-2022, Dr. Joselyn Chacón Madrigal, Ministra de Salud, requested that Eng. Roberto Guzmán Gutiérrez, Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, provide support for the inclusion of Chlorothalonil derivatives in the N4 parameter measurements performed by the Laboratorio Nacional de Aguas (folios 01770 al 01772 = folios 00073 al 00075).
On 07 de junio del 2022, memorandum No.PRE-LNA-2022-00320 was received by email in response to the request for an opinion regarding the ASADA Cipreses case, in which Eng. David Cambronero stated verbatim: “… the analysis results mentioned in the official letter concerning this matter were not obtained through an accredited method and, as indicated by Dr. Clemens Rupper, the method has likewise not been fully validated. Based on the foregoing, the results may be used as an alert and to direct efforts toward the validation and accreditation of methodologies for detecting and quantifying 1,3-dicarbamoil-2,4,5,6 tetraclorobenceno and 4-hidroxiclorotalonil…”[sic] “…In connection with the foregoing and as an immediate action by the LNA, it proceeded to send an official letter to the Presidencia Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados requesting personnel, supplies, and equipment for the development and accreditation of new analytical methodologies for the pesticides used in the area and the metabolites documented in the IRET results…” [sic] (folios 01775 al 01776 =folios 00076 al 00077).
With regard to point 4, in which the petitioners (recurrentes) assert that the actions of the respondent authorities allow the population to consume contaminated water, thereby violating the rights to health and life, the petitioners’ assertion is once again entirely false and wholly without basis in fact. This office has been carrying out a series of inter-institutional coordination efforts to secure a laboratory whose tests are accredited and duly validated and that can analyze the degradation products of Chlorothalonil, thereby making it possible to verify whether those metabolites are present in the water supplied by the ASADA de Cipreses to its customers. The foregoing is in compliance with Article 10 of Decreto N° 38924-S, Reglamento para la Calidad del Agua Potable y sus Reformas, as also demonstrated by ministerial directive MS-DM-5043-2022, signed by Dr. Joselyn Chacón Madrigal, Ministra de Salud, in which she requested that Eng.
Roberto Guzmán Gutiérrez, Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, provide support for the inclusion of Chlorothalonil derivatives in the N4 parameter measurements performed by the Laboratorio Nacional de Aguas (folios 01770 al 01772 = folios 00073 al 00075). Regarding the protection of the Plantón and Carlos Calvo springs (nacientes), since 2021 this Área Rectora de Salud has issued sanitary orders (órdenes sanitarias) to the owners of properties located within the protection zone (zona de protección) of those springs, as stipulated by Ley de Aguas N°276, ordering them to refrain from taking actions contrary to public health, pursuant to the precautionary principle (principio precautorio) and the principles of the regulations currently in force; this applies to actions committed within the area established by Ley de Aguas N°276 that endanger the water of the Plantón and Carlos Calvo Springs, as applicable (folios 00511 al 00525 = folios 00078 al 00085, de los folios 01623 al 01624 = 00086 al 00087 y de los folios 01627 al 01637 = folios 00090 al 00097).
It also issued an order to Mr. Virgilio Ulloa Ulloa, president of the ASADA de Cipreses, requiring him to demarcate the protection zones of the Plantón Spring and the Carlos Calvo Spring, taking this into consideration and treating it as a priority in order to ensure compliance with Ley de Aguas N°276 and with the provisions of Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados comunales N° 42582-S-MINAE, specifically Article 42 (folios 01625 al 01626 = folios 00088 al 00089). Furthermore, as a preventive measure, the ASADA de Cipreses must maintain surveillance over the protection zones of the Plantón and Carlos Calvo springs, which are currently used by the water-supply system (acueducto), to ensure that those zones are respected, and must notify this Área Rectora de Salud quarterly of the results of the inspections conducted to ensure the protection of those areas.
If any encroachment into the protection zones is detected, it must immediately report it to the relevant institutions so that appropriate action may be taken (folios 01757 al 01758 = folios 00098 al 00099). Your authority is hereby informed of the actions taken by the Ministerio de Salud in addressing the complaint to date. This office continues to fulfill its duties to the extent of its capabilities in order to ensure drinking water fit for human consumption in the community of Cipreses de Oreamuno. It has also addressed the matters reported by the petitioners in a timely manner, attending and responding to each of their requests.”.
Today, 17 de octubre de 2022, a meeting will be held between officials of this Laboratory and officials of the Ministry of Health at 13 hours; therefore, the results of the decisions made at that meeting must be requested from MINSA and ORAC Central Este.’ For its part, the Oficina Regional de Atención de Acueductos Rurales Central Este, in report GSD-UEN-GAR-2022-04189, dated 18 de octubre del 2022, states: ‘In response to the request for information concerning the ASADA Cipreses de Oreamuno case, as to whether “it is feasible for the communities receiving water service from the Plantón and Carlos Calvo springs to be supplied from another source—for example, from a municipal water system or a water system belonging to another ASADA,” this memorandum updates the information currently available on this matter. In the case of the Municipalidad de Oreamuno, the local government indicates that the water system it operates currently has a water deficit of more than 60 L/s and therefore, under current conditions, cannot provide any flow.
Additionally, the water-development project being implemented by this Municipality has not been completed and lacks both a water-treatment system and adequate pressure to permit, under the current conditions (design), an interconnection capable of meeting the needs of the communities supplied by ASADA Cipreses de Oreamuno. The Municipalidad de Alvarado has offered assistance during community meetings organized by this operating entity, but the location of its transmission and distribution pipelines in relation to the water system delegated to ASADA Cipreses de Oreamuno is unknown. In the case of ASADA Santa Rosa de Oreamuno, a report was issued on 15 de febrero de 2021 pursuant to AyA Board of Directors Resolution N°2007-350, “Procedure for AyA to Take Over Water-Supply and Sewerage Systems,” through official letter GSD-UEN-GAR-2021-00641 (Annex). This report details information regarding the technical feasibility of this operating entity serving the coverage area currently assigned to ASADA Cipreses de Oreamuno; however, the complete closure of the Plantón and Carlos Calvo springs was not assessed because specific data on contamination by chlorothalonil metabolites were unavailable.
A recent analysis identifies the need to increase the hydraulic capacity of the pipeline in sector 3 and to make significant improvements to an interconnection between the two systems (Cipreses and Santa Rosa) that was built in 1914. According to information provided by the ORAC engineering team, the improvement work required to achieve an interconnection with sufficient hydraulic capacity would take approximately 3 months. On 18 de octubre, in collaboration with the Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional (IRET-UNA), samples were collected from the springs of two ASADA Santa Rosa de Oreamuno systems to assess water quality in relation to the presence of metabolites of the fungicide chlorothalonil. This sampling resulted from the resolutions adopted at the meeting held at the National Water Laboratory on 17 de octubre, following confirmation by that institutional body that contamination by these compounds exceeded the level established by the standard.
In the case of ASADA San Pablo, insufficient data are available. The water balance and hydraulic capacity must be assessed because this operating entity lacks a Technical Study (Estudio Técnico), which must be comprehensively updated in accordance with the Reglamento de ASADAS. Complete sampling of the sources is planned to rule out the presence of chlorothalonil and its metabolites, together with a full review of the quality profile. For its part, ASADA Cipreses de Oreamuno must carry out several major projects to improve its hydraulic capacity, as indicated by a study conducted by the Centro de investigación en Vivienda Y Construcción del Instituto Tecnológico de Costa Rica; it has therefore been asked to provide priorities, costs, and estimated completion times. The budget available to ASADA Cipreses de Oreamuno may be insufficient to cover the necessary work over the medium term. At present, immediate interconnection is not technically feasible in any of the surrounding supply systems operated by ASADAS or any Municipality.
It is recommended that the report issued pursuant to AyA Board of Directors Resolution N°2007-350, “Procedure for AyA to Take Over Water-Supply and Sewerage Systems,” be updated; this requires an in-depth analysis of management and infrastructure, assessing the closure of the sources assigned to Cipreses de Oreamuno and the implications for the water balance and hydraulic capacity of both systems.’”
The protection of biodiversity on the basis of its intrinsic value derives from Advisory Opinion 23-17 of 15 de noviembre de 2017 of the Corte Interamericana de Derechos Humanos (paragraphs 56 to 68). It is important to note the recognition that this Chamber afforded biodiversity, with respect to bees, in decision Nº 2021024807, and previously in judgment 1999-12501, of 19 de febrero de 1999, protecting sea turtles. We therefore respectfully request consideration of the fact that, if an aquifer is contaminated, people are not the only ones harmed; birds, animals, soil, and so forth are also drawn into the situation because they need that water. Let us recall that section 9 of the Ley de la Biodiversidad establishes, as a general principle, respect for life in all its forms, and that this provision is connected to constitutional Article 50; we therefore request that this be so stated. We note that, in the judgment in Comunidades miembros de la Asociación Lhaka Honhat vs Argentina (paragraph 203), the Corte Interamericana de Derechos Humanos develops the content of the human right to a healthy environment through Article 26 of the Convención Americana de Derechos Humanos.
Specifically with respect to the situation in Argentina, the Court deemed components of the environment, such as forests and rivers, to be legally protected interests (intereses jurídicos) in their own right, even in the absence of certainty or evidence concerning the risk to individual persons.”

GSD-UEN-GAR-2022-04189 from the UEN Gestión de Acueductos Rurales indicated that, on 18 October 2022, sampling (muestreo) was conducted in collaboration with the Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional (IRET-UNA), as a result of the meeting held on 17 of that same month at the Laboratorio Nacional de Aguas. In view of the foregoing, as evidence to assist adjudication: “(clarify whether, as a result of the sampling conducted on 18 October, any health order (orden sanitaria) concerning the springs (nacientes) cited ut supra was issued to the ASADA de Cipreses de Oreamuno.)” ……
SECOND In response to the request, official letter MS-DRRSCE-DARSO-0848-2022 is attached, which indicates that the sampling conducted on 18 October was carried out at the ASADA de Santa Rosa de Oreamuno and not at the ASADA de Cipreses; therefore, no health order was issued concerning the cited springs.”
In light of what is stated in the decision issued at eleven hours and sixteen minutes on the twenty-first of October of two thousand twenty-two, I find it necessary to submit the following as evidence to assist adjudication: a- The health orders issued by the Ministerio de Salud requiring that we be provided with drinking water (agua potable) by tanker trucks, which even state that the water must not be used for personal hygiene because of the health risk posed by the contamination. The orders submitted are directed to the ASADA de Cipreses, the ICAA, and the MAG (see attachments). b- I ALSO SUBMIT the water report dated 20 October 2022, bearing sequential number: PRE-LNA-2022-00887, which concerns our water sources in Cipreses de Oreamuno and provides the basis for the health orders cited above. That document, issued by the Laboratorio Nacional de Aguas, shows that the limits permitted for human consumption are exceeded, with values of 19,36 μg/L for the Plantón spring and 1,73 μg/L for the Carlos Calvo spring (see attachments). c- I attach document MS-DM-9473-2022, in which the Minister of Health instructs that all the attached health orders be issued.
I must emphasize that the document states verbatim: “…if the MAG is unable to implement this action plan, a request must be made to prohibit chlorothalonil, due to its proven capacity to contaminate water sources and the limited capacity of the institutions to measure its metabolites.” d- I attach document MS-DRSA-0636-2022, in which the Minister of Health is urgently informed that the values of the chlorothalonil degradation products at issue exceed the maximum permissible value under regulation 38924-S, which is 0,1 ug/L. That document acknowledges that chlorothalonil has been prohibited in the European Union since 2019 because a critical problem was identified in connection with groundwater contamination by this pesticide. e- I must also point out that the response given by the Ministerio de Salud in its latest submission is not entirely accurate, because it has had the water reports concerning the contamination since August of the current year and is only now issuing the health orders.
From the foregoing, this authority will see that the problem is very serious, since not only is the water we drink being contaminated, but also the waters supplying downstream ecosystems, meaning that wildlife, soil, etc., are being affected. Accordingly, the necessary measures must be ordered to protect water resources (recurso hídrico) for the benefit of people and ecosystems, as required by constitutional provisions 21 and 50. Upon further consideration, we request that the relief sought be expanded and that chlorothalonil be prohibited in Costa Rica.”
The results are as follows:

Sampling will continue at the ASADAS in the northern area of Cartago to determine the presence of chlorothalonil metabolites, so that a comprehensive assessment of potential alternative sources may be conducted.’ In accordance with the foregoing, and on the basis of the report submitted and the evidence provided, the request of the Honorable Sala Constitucional for evidence to assist adjudication is hereby answered.”
I wish to submit for consideration in this case file the statement issued by the Asociación Provincial Cartaginesa de Médicos (APROCAME) on 02 September of this current year 2022. The physicians of APROCAME stated that ‘in light of this background, we wish to express emphatically the importance of protecting the water springs that supply the community of Cipreses de Oreamuno, thereby preventing contamination of this precious resource and possible harm to the health of the people in that locality.’ I respectfully wish to point out that the forthcoming ruling of this Honorable Court of Justice on the matter under consideration is of singular importance with respect to the most fundamental rights asserted in our claims, for the sake of future generations not only in Cipreses but throughout Costa Rica. Honorable Justices, you now have before you all the elements necessary for the State of Costa Rica to strengthen the Laboratorio Nacional de Aguas and protect public and environmental health from the unacceptable risks and impacts posed by chlorothalonil. In your hands lies a historic ruling for environmental justice in Costa Rica, particularly considering that water is now a human right. We place our hope in you for a better future free of agrotoxins in the water.”
Magistrate Rueda Leal drafts the opinion; and, Whereas (Considerando):
Supporting intervention (coadyuvancia) is a form of intervention in support of a party that occurs when a person participates in a proceeding by joining in the claims of one of the principal parties. Accordingly, anyone who has a direct interest in the outcome of the petition (recurso) has standing to participate as a supporting intervenor (coadyuvante). However, because the supporting intervenor is not a principal party, that person will not be directly affected by the judgment; that is, its effect cannot extend to that person directly and immediately, nor will the ruling’s status as res judicata (cosa juzgada) affect that person (see, among others, judgments n.°2010-000254, issued at 11:28 hours on 08 de enero de 2010, and n.° 2018019952, issued at 9:30 hours on 30 de noviembre de 2018). In this case, the Sala admits the supporting interventions filed because the applicants do have an interest in the outcome of this proceeding.
The petitioners state that the Platón and Carlos Calvo springs operated by the ASADA de Cipreses de Oreamuno de Cartago tested positive for pesticides, as acknowledged by the Instituto Costarricense de Acueductos y Alcantarillados, according to a study by the Instituto Regional de Estudios en Sustancias Tóxicas (IRET) of the Universidad Nacional. They add that report UNA-LAREP-OFIC-060-2021-S20-13-05-2021 of 17 de diciembre de 2021, issued by IRET, mentions the presence of degradation products (productos de la degradación) of the pesticide chlorothalonil, as well as traces of 9 different pesticides in the water from the aforementioned springs. They assert that the Ministerio de Salud is aware of the situation, as evidenced by technical report MS-DRRSCE-DARSO-IT-00312-2021. They indicate that the positive contamination results were submitted in 2021 to the Ministerio de Salud and the ASADA de Cipreses de Oreamuno de Cartago, but the corresponding measures to protect public and environmental health were not taken.
They specify that, beginning on 1° de abril de 2022, written complaints were filed with the Área Rectora de Salud de Oreamuno of the Ministerio de Salud and with the Gerencia General del Instituto Costarricense de Acueductos y Alcantarillados, requesting that water free of agrotoxic contaminants be supplied in tanker trucks pursuant to the precautionary principle (principio precautorio); that tests be conducted periodically to maintain continuous monitoring of chlorothalonil degradation products; that the pesticide-monitoring results be provided to them and made public; and that the protection areas (áreas de protección) surrounding the community’s water intakes be safeguarded. They state that, in response to the complaints, the ICAA’s Laboratorio Nacional de Aguas conducted a water analysis for certain pesticides but failed to address the presence of the specific chlorothalonil byproducts and neither analyzed nor reported the compounds “3-dicarbomoil-2,4,5, tetrachlorobenzene and 4-hydroxychlorothalonil”; despite this, it publicly asserted that the water was potable. They emphasize that IRET of the Universidad Nacional, the Ministerio de Salud, and the Instituto Costarricense de Acueductos y Alcantarillados itself have acknowledged the water contamination.
The following facts are deemed duly established and relevant to the determination of this matter, either because they have been proven or because the respondent authority failed to address them, as directed in the initial order (auto inicial):
Regarding the ICAA:
Based on all of the foregoing, it is concluded that these analyses cannot yet be deemed conclusive in relation to the Reglamento para la Calidad del Agua Potable N° 38924-S, without this preventing ORAC from taking any preventive/corrective measures it deems appropriate.” Nevertheless, the General Manager of ICAA reports: “The Institution continues its efforts to arrange collaboration with a laboratory at the national or international level in order to determine, on a scientific basis and in compliance with the Regulations applicable to the subject matter, the presence of chlorothalonil metabolites.” (Report of the respondent authority and documentary evidence).
In this regard, the Oficina Regional Central Este, in coordination with the ASADA, will conduct periodic visits to inspect the protection areas and, upon detecting any alterations, will notify the Ministerio de Salud so that it may take the corresponding measures. It is incorrect to state that no actions have been taken to protect the water. In addition to the procedures described in HECHO OCTAVO, the Subgerencia de Gestión de Sistemas Delegados formulated a Water Safety Plan (Plan de Seguridad del Agua) (anexo 2) to address the identified problem and implement specific mitigation measures. The objective of the Action Plan is to propose and implement a Comprehensive Risk Management System (Sistema Integral Gestión del Riesgo) for the ASADA de Cipreses de Oreamuno, thereby identifying and assessing risks throughout the service-delivery process so that actions to mitigate them may be defined.
To that end, the Subgerencia de Gestión de Sistemas Delegados will collaborate and provide methodological support for the development and implementation of the Plan de Seguridad del Agua (PSA), based on the institutional methodology.” (Documentary evidence).
Special follow-up is being conducted so that the consultants retained by the ASADA may correct the reports submitted to AyA, because to date these technical materials do not meet the requirements of this Institutional unit. In addition, the ASADA has requested that the UEN Gestión Ambiental of AyA conduct a hydrogeological study to delimit the special protection area (área de protección especial) of the Carlos Calvo and Plantón springs (anexo 3). In response, the operating entity is compiling the requirements, including authorization from the property owners for AyA hydrogeologists to enter and conduct the corresponding analyses. The Ministerio de Salud has issued sanitary orders to the property owners who carried out agricultural work near the Naciente Plantón (anexo 4); therefore, restriction measures have already been implemented by other State Institutions in support of the management of the potential contamination case.
Once the studies have been corrected and approved by the UEN Gestión Ambiental, and the hydrogeological behavior of the springs, the recharge zone (zona de recarga), and the protection zone (zona de protección) have been determined, specific measures may be taken to ensure comprehensive protection of the water resource and the forest-cover areas (áreas de cobertura boscosa) required to maintain its quantity and quality (…)” (Documentary evidence).
In the case of ASADA Santa Rosa de Oreamuno, on 15 de febrero de 2021, a report was issued pursuant to AyA Board of Directors Resolution N°2007-350, “Procedure for AyA to Take Over Aqueduct and Sewerage Systems” (“Procedimiento para asumir sistemas de acueductos y alcantarillados por AyA”), through official letter GSD-UENGAR-2021-00641 (Annex). This report details information concerning the technical feasibility (factibilidad técnica) of this operating entity’s operation of the service area currently assigned to ASADA Cipreses de Oreamuno; however, the complete closure of the Plantón and Carlos Calvo springs (nacientes) was not evaluated because specific data on contamination by Chlorothalonil metabolites were unavailable.
A recent analysis found that it is necessary to increase the hydraulic capacity (capacidad hidráulica) of the pipeline in sector 3 and make significant improvements to an interconnection between the two systems (Cipreses and Santa Rosa) built in 1914. According to information provided by the ORAC engineering team, the improvement works required to establish an interconnection with sufficient hydraulic capacity would take approximately 3 months. On 18 de octubre, in collaboration with the Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional (IRET-UNA), samples were taken from the springs of two ASADA Santa Rosa de Oreamuno systems to assess water quality in relation to the presence of metabolites of the fungicide Chlorothalonil. This sampling arose from the resolutions adopted at the meeting held at Laboratorio Nacional de Aguas on 17 de octubre, following confirmation by that institutional body that contamination by these compounds exceeded the level established by the standard.
In the case of ASADA San Pablo, insufficient data are available. The water balance (balance hídrico) and hydraulic capacity must be assessed because this operating entity lacks a Technical Study (Estudio Técnico), which must be comprehensively updated in accordance with the Reglamento de ASADAS. Comprehensive sampling of the sources is planned to rule out the presence of Chlorothalonil and its metabolites, as well as a complete review of the quality profile.
For its part, ASADA Cipreses de Oreamuno must undertake several major works to improve its hydraulic capacity, as shown by a study conducted by Centro de investigación en Vivienda Y Construcción del Instituto Tecnológico de Costa Rica, for which it has been asked to provide priorities, costs, and estimated completion times.
The budget available to ASADA Cipreses de Oreamuno may not be sufficient to cover the works required in the medium term. To date, there is no technical feasibility for immediate interconnection with any of the surrounding supply systems operated by ASADAS or a Municipality. It is recommended that the report issued pursuant to AyA Board of Directors Resolution N°2007-350, “Procedure for AyA to Take Over Aqueduct and Sewerage Systems,” be updated by conducting an in-depth analysis of management and infrastructure, assessing the closure of the sources assigned to Cipreses de Oreamuno and the implications for the water balance and hydraulic capacity of both systems.” (Report from the respondent authority and documentary evidence).

To carry out this project, technical matters were discussed at a meeting with Mr. Clemens Ruepert, an IRET official, who mentioned the possibility of determining the metabolite 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene using the gas chromatography technique (GC-MS) at the Laboratorio Nacional de Agua (LNA), although they ultimately obtained better results using the HPLC-MS technique. With respect to the metabolite 4-hydroxychlorothalonil, based on IRET’s acquired experience, it was determined that gas chromatography is not the appropriate technique and that liquid chromatography (HPLC-MS) is the suitable technique. As part of the joint collaborative efforts, IRET offered and supplied the LNA with a 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene standard, as well as the extraction cartridges used by that laboratory to determine that metabolite, so that the LNA could conduct the corresponding tests and determine whether that metabolite could be detected using the GC-MS technique.
The LNA performed the following tasks using the metabolite standard supplied by IRET: 1. A scan study was conducted (using a high concentration, ppm) to determine whether the equipment could detect the compound and establish its retention time. This study produced good results because the metabolite could be detected. 2. Based on the expertise of the LNA technicians, a new method was designed, including chromatographic conditions for temperature, time, and gradient. This study required several adjustments until a method yielding an improved chromatographic peak shape was obtained. 3. An Auto SRM-type study was conducted to determine the mass transitions and ionization energies that produced the best results in terms of chromatographic peak intensity. 4. A large number of tests were conducted by varying equipment conditions, metabolite concentrations, and solvents, and reviewing in each case the variations in retention time and the spectrometric conditions of the analysis. 5.
To carry out further optimization, a virtual meeting was held on 9 September 2022 with Mr. Clemens Ruepert for the purpose of exploring possible cooperation between the institutions, presenting the methodological data and results to him, and obtaining feedback and recommendations. 6. The recommendations concerning the heating ramps were applied as indicated by Mr. Ruepert, and new tests were conducted using different standard concentrations. In addition, on 23/8/2022 (AyA-OT-2203554), the LNA collected samples from the Plantón spring and the Carlos Calvo spring to conduct tests as part of developing the methodology for analyzing the metabolite 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene. The presence of the metabolite was suspected, but the method still required further development. According to the study conducted with the supplied standard, it was found that although the GC-MS technique permits detection of the metabolite 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene, it has sensitivity limitations, since the minimum concentration of the standard that could be quantified was 250 μg/L.
This means that, using the current sample pretreatment, the method’s limit of quantification would be at least 0.63 μg/L, whereas national regulations require values of 0.1 μg/L or less. Additionally, to optimize the method, it was agreed that samples would again be collected jointly with IRET in the community of Cipreses so that tests could be conducted using recent samples. This sampling was carried out on 26/9/2022, AYA-OT-2203999, and samples were collected for processing at the LNA and at IRET. Samples collected on 26/09/2022. Given the sensitivity limitations of the method under development, the samples collected from the two springs in the community of Cipreses (Plantón and Carlos Calvo) were injected, together with five standards of 250 μg/L, 500 μg/L, 750 μg/L, 1000 μg/L, and 2000 μg/L. The results obtained are detailed below: For the Plantón spring, an approximate concentration of 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene of 19.36 μg/L was obtained in the collected sample, while for the Carlos Calvo spring, the approximate concentration in the collected sample was 1.73 μg/L.
For the determinations in both sampling rounds, the standard provided by Mr. Clemens Ruepert was used. It should be noted that the standard used is not certified with traceability under the terms of accreditation pursuant to international standard INTE-ISO/IEC 17025:2017 (nor has a standard meeting this requirement been found). Additionally, the method used for this determination is not accredited and currently lacks the corresponding validation, resulting in little certainty regarding the compound’s exact concentration. Nevertheless, the concentrations found exceed the maximum admissible value established in regulation DE 38924-S. These results make it necessary and imperative to strengthen the Laboratorio Nacional de Aguas by providing it with physical space, equipment, and supplies to introduce new analyses, such as those for the aforementioned metabolites, in order to maintain adequate monitoring and control.
It is also advisable to establish an interinstitutional commission to analyze the results presented in this report, take immediate action regarding them, and prepare corrective, preventive, and risk-minimization measures for the population of Cipreses de Oreamuno.” (Documentary evidence).
With respect to the Área Rectora de Salud:
In the specific case of the metabolites 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene and 4-hydroxychlorothalonil, little documentation is available, particularly regarding their effects on human health, although somewhat more (sic) information exists regarding the environmental and ecotoxicological risks of 4-hydroxychlorothalonil. According to a review of chlorothalonil and its international status, the Unión Europea decided in 2019 to prohibit its use because a critical problem was identified concerning groundwater contamination by the pesticide’s metabolites. The Autoridad Europea could not rule out a potential genotoxicity concern arising from the residues to which consumers would be exposed and found a high risk to amphibians and fish in all assessed uses. Chlorothalonil itself is also classified as carcinogenic. 1 In contrast, the Agencia de Protección Ambiental de los Estados Unidos (EPA) has determined that chlorothalonil products do not pose risks to humans or the environment provided that authorized uses and the directions on the product label are followed.
However, it has stated that there is a lack of studies for determining the risks posed by its metabolites. 2 In conclusion, from a human-health standpoint, there is insufficient scientific research characterizing and identifying health risks associated with the consumption, ingestion, or any other type of contact with the metabolites 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene and 4-hydroxychlorothalonil; however, studies do characterize chlorothalonil as highly toxic to aquatic life and moderately toxic to birds and earthworms. In addition, 4-hydroxychlorothalonil has been classified as highly toxic in a study conducted on rodents. 3 Accordingly, any indication of contamination by this pesticide or metabolite must be treated with extreme caution, and the necessary measures must be taken to prevent its ingestion or contact, given the limited scientific evidence concerning human health and in reliance on the studies confirming its ecotoxicity and risk to environmental health.’” (Documentary evidence).
Consideration may be given to using water from these sources for flushing toilets and other household cleaning and disinfection activities. · A Sanitary Order is issued to the Instituto Costarricense de Acueductos y Alcantarillados requiring it to provide (sic) water to the community immediately by tanker trucks or any other mechanism that ensure (sic) the availability of safe water for human consumption among the population of Cipreses. · A Sanitary Order is issued to ASADA Cipreses and the Instituto Costarricense de Acueductos y Alcantarillados requiring them to communicate accurately and assertively to the community, through as many channels as possible, the situation affecting ASADA Cipreses concerning the metabolites of the pesticide chlorothalonil and the application of the precautionary principle to prevent health problems among the population. It should be noted that the Ministerio de Salud must perform an oversight role in this process. · An Action Plan containing short-, medium-, and long-term measures is requested by Sanitary Order from the Instituto Costarricense de Acueductos y Alcantarillados within a reasonable statutory period, specifying the timeframes to be followed to resolve the contamination affecting ASADA Cipreses, whether through interconnections with other ASADAS, the search for new sources, the implementation of treatment systems, or other measures, as determined by its technical authority over drinking water. · Through the DRRS Central Este and the ARS de Oreamuno, the local and/or regional office of the Ministerio de Agricultura is requested to take immediate action to identify substitute molecules, ensure good agricultural practices and the proper use of pesticides, particularly chlorothalonil; the measures implemented must be linked to performance indicators so that the results obtained may be measured, monitored, and compared in order to determine whether contamination has been mitigated and reduced, with the aim of remediating the water sources; if MAG cannot implement this action plan, a request to prohibit chlorothalonil must be pursued, due to its proven ability to contaminate water sources and the institutions’ limited capacity to measure its metabolites.” (Documentary evidence).
aa) By means of health order (orden sanitaria) MS-DRRSCE-DARSO-OS-0087-2022 of 20 de octubre de 2022, the Área Rectora de Salud ordered the president of the ASADA de Cipreses as follows: “Deadline for compliance with the health order: IMMEDIATELY (…)
Proceed with the immediate closure of the water sources used for human consumption by the ASADA de Cipreses de Oreamuno, specifically the Plantón and Carlos Calvo sources. In the absence of information characterizing and identifying health risks associated with the consumption, ingestion, or any other type of contact with the metabolites, the water from these sources may not be used for human consumption, food preparation, or personal hygiene activities, in accordance with the precautionary principle (principio precautorio). Consideration may be given to using water from these sources for the operation of toilets and other household cleaning and disinfection activities.” Health order MS-DRRSCE-DARSO-OS-0091-2022 was also served upon him, providing: “1) Urgently inform the community of Cipreses, accurately and assertively and through as many channels as possible, of the situation affecting the ASADA DE Cipreses concerning metabolites of the pesticide Chlorothalonil and the application of the precautionary principle, for the purpose of preventing health problems among the population, as well as of the supply of water by tanker trucks.” (Documentary evidence).
bb) By means of health order MS-DRRSCE-DARSO-OS-0088-2022 of 20 de octubre de 2022, addressed to the executive president of the ICAA, the Área Rectora de Salud de Oreamuno ordered: “Deadline for compliance with the health order: IMMEDIATELY (…) 1) Immediately provide water to the community of Cipreses de Oreamuno by means of tanker trucks or any other mechanism that ensures the availability of safe water for human consumption. (…)”. Likewise, health order MS-DRRSCE-DARSO-OS-0095-2022 was issued, also addressed to the aforementioned agency, ordering: “Deadline for compliance with the health order: 10 calendar days (…) 1) Submit to the Área Rectora de Salud de Oreamuno a Corrective Action Plan identifying the person responsible for analyzing the activities and a schedule detailing the dates on which the activities will be carried out, with short-, medium-, and long-term actions, within a reasonable statutory period, indicating the steps to be followed to resolve the contamination affecting the ASADA de Cipreses, whether through interconnections with other ASADAS, the search for new sources, the implementation of treatment systems, among other measures, as determined by its technical authority over drinking water (agua potable).” (Documentary evidence).
On repeated occasions, the case law of this Chamber has emphasized that the right to a healthy and ecologically balanced environment is recognized at both the constitutional and treaty levels. It has likewise stated that the effective protection of this right requires resources to be used rationally, in which context the State and citizens in general must act in accordance with the principles governing environmental matters. Along these lines, specialized legal scholarship has indicated that the preventive principle (principio preventivo) requires that, when there is certainty regarding possible environmental harm, the harmful activity must be prohibited, restricted, or made subject to compliance with certain requirements. In general, this principle applies when risks are clearly defined and identified as being at least probable; it is also useful when there are no technical reports or administrative permits guaranteeing the sustainability of an activity, but sufficient grounds exist to anticipate potential adverse impacts.
The precautionary principle, in turn, provides that when there is a threat of serious and irreversible harm, a lack of absolute scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation. It follows from the foregoing that the principle is based on reasonable scientific uncertainty coupled with the threat of serious and irreversible environmental harm. In general terms, a relevant distinction between the preventive principle and the precautionary principle lies in the level of knowledge and certainty regarding the risks posed by an activity or project. While such certainty exists under the former, the latter involves a state of doubt resulting from scientific information or technical studies. Thus, the Costa Rican State is obligated to adopt measures that ensure the effective defense and preservation of the environment in accordance with those principles.
This objective obligation does not, however, inevitably entail an individual right for persons to demand, through the courts, that a particular measure be taken, but it does entail a right to have suitable measures adopted to protect that right when authorities—or natural or legal persons—act with manifest negligence, pursuant to the recognized theory of the horizontal effect of fundamental rights (teoría de la eficacia horizontal de los derechos fundamentales; Drittwirkung der Menschenrechte), among whose procedural manifestations is the amparo proceeding (amparo) against private-law parties.
In the sub lite case, the appellants state that the Platón and Carlos Calvo springs (nacientes), belonging to the ASADA de Cipreses de Oreamuno de Cartago, tested positive for pesticides, as acknowledged by the Instituto Costarricense de Acueductos y Alcantarillados, according to a study by the Instituto Regional de Estudios en Sustancias Tóxicas (IRET) of the Universidad Nacional. They add that report UNA-LAREP-OFIC-060-2021-S20-13-05-2021 of 17 de diciembre de 2021, issued by IRET, mentions the presence of degradation products of the pesticide chlorothalonil, as well as traces of 9 various pesticides in the water from the aforementioned springs. They assert that the Ministerio de Salud was aware of the situation, as recorded in technical report MS-DRRSCE-DARSO-IT-00312-2021. They state that the positive contamination results were submitted in 2021 to the Ministerio de Salud and the ASADA de Cipreses de Oreamuno de Cartago, but the corresponding measures to protect public health and the environment were not taken.
They specify that, beginning on 1° de abril de 2022, written complaints were submitted to the Área Rectora de Salud de Oreamuno of the Ministerio de Salud and to the Gerencia General del Instituto Costarricense de Acueductos y Alcantarillados, requesting that water free of agrotoxic contaminants be supplied in tanker trucks under the precautionary principle; that periodic analyses be conducted to ensure continuous monitoring of chlorothalonil degradation products; that the pesticide-monitoring results be provided to them and made public; and that the protection areas surrounding the community’s water intakes be safeguarded. They state that, in response to the complaints, the Laboratorio Nacional de Aguas del ICAA conducted a water analysis for certain pesticides, but omitted any reference to the presence of the specific chlorothalonil breakdown products and neither analyzed nor reported the compounds “3-dicarbomoil-2,4,5, tetrachlorobenzene and 4-hydroxychlorothalonil”; nevertheless, it publicly asserted that the water was fit for drinking. They emphasize that IRET of the Universidad Nacional, the Ministerio de Salud, and the Instituto Costarricense de Acueductos y Alcantarillados itself have acknowledged the water contamination.
The case file demonstrates that the Pesticide Residue Analysis Laboratory of the Instituto Regional de Estudios en Sustancias Tóxicas of the Universidad Nacional (UNA), by official letter no. UNA-LAREP-OFIC-060-2021-S20-13-05-2021 of 17 de diciembre de 2021, addressed to the ASADA de Cipreses de Oreamuno, stated: “Attached is the report containing the results of the analysis of pesticide residues (residuos de plaguicidas) in the water samples collected on 26 de octubre 2021 at the Carlos Calvo and Plantón springs (nacientes) (…) In the sample collected at the Naciente Carlos Calvo, we did not find pesticide residues included in the analysis (…) In the sample collected at the Naciente Plantón, we did not find pesticide residues included in the analysis (…) We did detect several pesticide residues at trace levels, below the reporting limit (límite de reporte). We had detected several of these pesticide residues at trace levels in samples collected previously.
We continue to find these degradation products of the fungicide chlorothalonil; this time, the analytical report includes the concentrations detected in the samples of 1,3-dicabamil, 2,4,5,6-tetrachlorobenzene, and 4-hydroxychlorothalonil. In the sample collected at the Naciente Plantón, we quantified both substances, and at the Naciente Carlos Calvo, only the first.” The Laboratorio Nacional de Aguas of ICAA, by memorandum no. PRE-LNA-2022-00193, of 28 de marzo de 2022, states: “In accordance with your official letter GSD-UEN-GAR-2022-01098, and in response to the review and opinion requested from the Laboratorio Nacional de Aguas, after reviewing the respective reports, the following observations are made: 1- It is noted that the analyses performed by IRET do not fall within the scope of accreditation (alcance de acreditación) under International Standard INTE-ISO/IEC 17025:2017. 2- Article 10 of the Reglamento para la Calidad del Agua Potable N° 38924-S requires public operating entities to submit analytical reports issued by laboratories whose testing methods are accredited, as established by Article 34 of Ley Nº 8279 of 02 de mayo del 2002, ‘Sistema Nacional para la Calidad,’ published in the Diario Oficial La Gaceta Nº 96 of 21 de mayo del 2002. 3- The analytes that exceeded the permitted Maximum Value established for pesticides in the Reglamento para la Calidad del Agua Potable N° 38924-S were 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene and 4-hydroxychlorothalonil, which are metabolites of the pesticide chlorothalonil. 4- In official letter UNA-LAREP-OFI-060-2021 S20-13-05-2021, IRET states that ‘We still need to perform some tests to optimize the determination of these compounds in water and soil samples.’ The Laboratorio Nacional de Aguas therefore understands that further laboratory testing is still required for the method used to determine these metabolites to be properly validated.
In view of all the foregoing, it is concluded that these analyses cannot yet be considered conclusive in relation to the Reglamento para la Calidad del Agua Potable N° 38924-S, without this preventing ORAC from taking any preventive/corrective measures it deems appropriate.” Nevertheless, ICAA’s general manager reports: “The Institution continues conducting inquiries aimed at securing the cooperation of a national or international laboratory in order to determine, on a scientific basis and in compliance with the Regulations applicable to the subject matter, the presence of chlorothalonil metabolites.” On 1° de abril de 2022, the petitioner [Nombre 002] filed a complaint with ICAA regarding the situation alleged in these proceedings. The ICAA authorities explain that the metabolites “1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene and 4-hydroxychlorothalonil” were not reported directly by the institution because the Laboratorio Nacional de Aguas analyzed the pesticides for which it is accredited, including chlorothalonil.
They explain that the aforementioned metabolites do not fall within the laboratory’s accredited scope. It therefore maintains that the existence of contamination cannot be declared and that the IRET (UNA) results may be treated only as an alert, not as conclusive data. ICAA has undertaken efforts to acquire the supplies necessary to expand its analytical scope so that the studies cover the metabolites alleged in the matter at issue; however, the respective administrative procurement procedures (contrataciones administrativas) must be conducted. By memorandum GSD-UEN-GAR-2022-02876 of 21 de julio de 2022, the UEN Gestión de Acueductos Rurales stated: “Regarding protection areas (áreas de protección), the ASADA is currently conducting comprehensive hydrogeological studies and hydrogeological studies of protection areas, which will provide valuable data for effectively monitoring these areas.
Sanitary orders (órdenes sanitarias) have been issued by the Ministerio de Salud to the farmers who were located within the protection area (…) efforts are currently underway to correct and obtain approval of the hydrogeological studies of the springs in question; sanitary orders have been issued to the owners who cultivated crops within the protection area; and the aqueduct participates in the Programa Sello de Calidad Sanitaria of the Laboratorio Nacional De Aguas, which ensures that analyses are being conducted to determine the potability of the water, as well as assessments of the risk factors associated with the condition of the protection areas. In this regard, the Oficina Regional Central Este, in coordination with the ASADA, will conduct periodic visits to inspect the protection areas, and if alterations are detected, the Ministerio de Salud will be notified so that it may take the corresponding measures.
It is incorrect to assert that no action has been taken to protect the water. In addition to the procedures described under EIGHTH FACT, the Subgerencia de Gestión de Sistemas Delegados formulated a Water Safety Plan (Plan de Seguridad del Agua) (Anexo 2) to address the identified issue and take specific mitigation measures. The objective of the Action Plan is to propose and implement a Comprehensive Risk Management System for the ASADA de Cipreses de Oreamuno and thereby identify and assess risks throughout the service-delivery process, making it possible to define measures to mitigate them. To this end, the Subgerencia de Gestión de Sistemas Delegados will provide assistance and methodological support for developing and implementing the Water Safety Plan (PSA), based on the institutional methodology.” By memorandum GSD-UEN-GAR-2022-02876 of 21 de julio de 2022, the UEN Gestión de Acueductos Rurales stated: “It cannot be established that the population of Cipreses de Oreamuno is consuming contaminated water because it has not been technically possible to determine whether the water at the Plantón and Carlos Calvo springs is being affected by pesticide residues, nor has it been possible to quantify chlorothalonil metabolites through a laboratory possessing an accredited analytical method, according to the opinion of the Laboratorio Nacional De Aguas.
Additional analyses must therefore be performed before the contamination protocol can be applied, which would support measures such as possibly closing the source for human consumption and distributing water by tanker trucks, in accordance with institutional procedures (…) the hydrogeological studies for the Plantón, Carlos Calvo, and Edwin Coto (not in use) springs are currently under review by AyA’s UEN Gestión Ambiental. Special follow-up is being conducted so that the consultants retained by the ASADA can correct the reports submitted to AyA, because these technical materials currently fail to meet the requirements of this institutional division. In addition, the ASADA has requested that AyA’s UEN Gestión Ambiental conduct a hydrogeological study to delimit the special protection area of the Carlos Calvo and Plantón springs (Anexo 3). In response, the operating entity is gathering the requirements, including authorization from the owners for AyA hydrogeologists to enter and conduct the corresponding analyses.
The Ministerio de Salud has issued sanitary orders to the owners who conducted agricultural activities near the Naciente Plantón (Anexo 4); thus, restriction measures have already been implemented by other State Institutions in support of managing this potential contamination case. Once the corrected studies have been approved by the UEN Gestión Ambiental and the hydrogeological behavior of the springs, the recharge zone (zona de recarga), and the protection zone have been determined, specific measures may be taken to provide comprehensive protection of the water resource and the areas of forest cover (cobertura boscosa) required to maintain its quantity and quality (…)” By memorandum GSD-UEN-GAR-2022-04189 of ICAA’s UEN Gestión de Acueductos Rurales, it was stated: “In the case of the Municipalidad de Oreamuno, the local government indicates that its managed aqueduct system currently has a water deficit of more than 60 L/s and that, under current conditions, it therefore cannot provide any flow.
Furthermore, the utilization project being carried out by this Municipalidad has not been completed and lacks both a water treatment system and adequate pressure that, under the current conditions (design), would permit an interconnection capable of meeting the needs of the communities supplied by the ASADA Cipreses de Oreamuno. The Municipalidad de Alvarado has offered assistance during community meetings organized by this operating entity, but the location of the conveyance and distribution pipelines relative to the aqueduct system delegated to the ASADA Cipreses de Oreamuno is unknown. In the case of the ASADA Santa Rosa de Oreamuno, on 15 de febrero de 2021, a report was issued pursuant to AyA Board of Directors Resolution N°2007-350, ‘Procedure for AyA to Assume Aqueduct and Sewerage Systems,’ through official letter GSD-UENGAR-2021-00641 (Anexo). This report details information concerning the technical feasibility of this operating entity serving the coverage area currently assigned to the ASADA Cipreses de Oreamuno; however, the complete closure of the Plantón and Carlos Calvo springs was not evaluated because specific data on contamination by chlorothalonil metabolites were unavailable.
A recent analysis determines that it is necessary to increase the hydraulic capacity of the pipeline in sector 3 and make major improvements to an interconnection between the two systems (Cipreses and Santa Rosa) built in 1914.
According to information provided by the ORAC engineering team, the improvement works required to establish an interconnection (interconexión) with sufficient hydraulic capacity (capacidad hidráulica) would take approximately 3 months. On 18 de octubre, in collaboration with the Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional (IRET-UNA), samples were collected from the springs (nacientes) of two systems operated by ASADA Santa Rosa de Oreamuno to assess water quality (calidad de agua) in relation to the presence of metabolites of the fungicide chlorothalonil (Clorotalonil). This sampling arose from the agreements reached at the meeting held at the Laboratorio Nacional de Aguas on 17 de octubre, following confirmation by that institutional body that contamination by these compounds exceeded the level established by the applicable standard (norma). In the case of ASADA San Pablo, insufficient data are available.
The water balance (balance hídrico) and hydraulic capacity must be assessed because this operating entity does not have a Technical Study (Estudio Técnico), which must be comprehensively updated in accordance with the ASADA Regulations (Reglamento de ASADAS). Comprehensive sampling of the sources is planned in order to rule out the presence of chlorothalonil and its metabolites, as well as a complete review of the quality profile (perfil de calidad). For its part, ASADA Cipreses de Oreamuno must carry out several major works to improve its hydraulic capacity, as indicated by a study conducted by the Centro de investigación en Vivienda Y Construcción del Instituto Tecnológico de Costa Rica; accordingly, it has been asked to provide the prioritization, costs, and estimated completion time for those works. The budget available to ASADA Cipreses de Oreamuno may not be sufficient to cover the works required in the medium term.
To date, none of the surrounding supply systems (sistemas de abastecimiento), administered by ASADAS or a Municipality, has the technical feasibility (factibilidad técnica) required for immediate interconnection. It is recommended that the report be updated pursuant to AyA Board of Directors Resolution N°2007-350, “Procedure for AyA to Assume Control of Water-Supply and Sewerage Systems” (“Procedimiento para asumir sistemas de acueductos y alcantarillados por AyA”), under which an in-depth analysis of management and infrastructure must be conducted, assessing the closure of the sources assigned to Cipreses de Oreamuno and the implications for the water balance and hydraulic capacity of both systems.” Through memorandum GSD-UEN-GAR-2022-04290 of 25 de octubre de 2022, the UEN Gestión Acueductos Rurales stated: “The sampling conducted on 18 y 19 de octubre by personnel from the Oficina Regional Central Este del AyA, in coordination with the IRET Laboratory at the Universidad Nacional, focused on ASADA Santa Rosa De Oreamuno and covered its 3 systems and 7 springs.
The analyses are being performed at the IRET laboratory, and the results are expected to be available this week, provided that the equipment continues operating under normal conditions. The purpose of this sampling is to establish a quality baseline (línea base de calidad) regarding the presence of metabolites of the fungicide chlorothalonil, in anticipation of a possible interconnection of the systems in the context of the closure of the sources used by ASADA Cipreses de Oreamuno. In the case of the Plantón and Carlos Calvo springs, this sampling had previously been conducted by the Laboratorio Nacional de Aguas on 26 de septiembre de 2022, and the resulting report was issued under code AYA-FPT-011B (annex), signed by the head of the Laboratorio de Química, Luis Zúñiga Zúñiga, and approved by Dr. Darner Mora Alvarado, director of this institutional department. The results are as follows:

(c) 0,5 At the meeting held on 17 de octubre at the Laboratorio Nacional de Aguas in Tres Ríos, representatives of the Ministerio de Salud (regional and central), the Universidad Nacional – IRET, and, on behalf of AyA, the Laboratorio Nacional de Aguas, Oficina Regional Central Este, and Subgerencia De Gestión de Sistemas Delegados were present. At that meeting, the following agreements were reached, which are transcribed verbatim from the attached log, sent by email by the Ministerio de Salud: 1. Processing of samples to be collected at the ASADA of Santa Rosa 2. Coordinate delivery of sampling materials 3. Assistance with and monitoring of sampling at the ASADA of Santa Rosa 4. Delivery of LNA - IRET results reports 5. Internal coordination in the event of a possible intervention in the water-supply system (sistema de abastecimiento de agua) Sampling will continue at the ASADAS in the northern area of Cartago to determine the presence of Chlorothalonil metabolites, so that a comprehensive assessment of potential alternative sources can be conducted.” In the report of 19 de octubre de 2022, signed by Dr. Darner Mora Alvarado, an ICAA official, it was stated: “SUBJECT: Results of the analysis of the Cipreses samples and tests for developing a method to determine Chlorothalonil metabolites.
Due to the alerts issued by the Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional (IRET) concerning the alleged discovery of metabolites of the pesticide (plaguicida) Chlorothalonil in the Plantón spring (naciente) and the Carlos Calvo spring, which are sources of drinking-water supply for the ASADA Cipreses de Oreamuno, and the requests made by the Ministerio de Salud, it was agreed to undertake a joint Project for the Development of methodologies to determine pesticides and their metabolites in water, of mutual interest to the Laboratorio Nacional de Aguas del Instituto Costarricense de Acueductos y Alcantarillados and IRET, all under the oversight of the Ministerio de Salud. To carry out this project, technical aspects were discussed at a meeting with Mr. Clemens Ruepert, an IRET official, who mentioned the possibility of determining the metabolite 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene using the gas chromatography technique (cromatografía de gases, GC-MS) at the Laboratorio Nacional de Agua (LNA), even though they ultimately obtained better results using the HPLC-MS technique.
With respect to the metabolite 4-hydroxychlorothalonil, based on IRET’s experience, it was determined that gas chromatography is not the appropriate technique and that liquid chromatography (cromatografía líquida, HPLC-MS) is the suitable one. As part of the joint collaborative efforts, IRET offered and supplied LNA with a 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene standard (patrón), as well as the extraction cartridges used by that laboratory to determine that metabolite, so that LNA could conduct the corresponding tests and determine whether the metabolite could be detected using the GC-MS technique. LNA performed the following tasks using the metabolite standard supplied by IRET: 1. A scan study (estudio de barrido) was conducted, using a high concentration, ppm, to determine whether the equipment could detect the compound and to determine its retention time. This study yielded good results because the metabolite could be detected. 2.
Based on the expertise of LNA technicians, a new method was designed, including chromatographic conditions for temperature, time, and gradient. This study required several adjustments until a method producing a better chromatographic peak shape was obtained. 3. An Auto SRM-type study was conducted to determine the mass transitions and ionization energies that produced the best results in terms of chromatographic peak intensity. 4. A large number of tests were conducted by varying equipment conditions, metabolite concentrations, and solvents and, in each case, examining variations in retention time and the spectrometric conditions of the analysis. 5. To carry out additional optimization, a virtual meeting was held on 9 de setiembre de 2022 with Mr. Clemens Ruepert for the purpose of possible cooperation between the institutions, presenting him with the methodological data and results, and obtaining feedback and recommendations. 6.
The recommendations concerning heating ramps were implemented as indicated by Mr. Ruepert, and new tests were conducted with different standard concentrations. In addition, on 23/8/2022, LNA collected samples from the Plantón spring and the Carlos Calvo spring (AyA-OT-2203554) to perform tests as part of the development of the methodology for analyzing the metabolite 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene. Evidence suggesting the presence of the metabolite was found, but the method still required further development. According to the study conducted with the supplied standard, although the GC-MS technique permits detection of the metabolite 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene, it has sensitivity limitations, because the minimum quantifiable concentration of the standard was 250 μg/L. This means that, using the current sample pretreatment, the method’s limit of quantification (límite de cuantificación) would be at least 0,63 μg/L, whereas national regulations require values of 0,1 μg/L or less.
Additionally, to optimize the method, it was agreed that samples would again be collected jointly with IRET in the community of Cipreses so that testing could be conducted using recent samples. This sampling was carried out on 26/9/2022, AYA-OT-2203999, and samples were collected for processing at LNA and at IRET. Samples collected on 26/09/2022. Given the sensitivity limitations of the method under development, the samples collected from the two springs in the community of Cipreses (Plantón and Carlos Calvo) were injected, as were five standards of 250 μg/L, 500 μg/L, 750 μg/L, 1000 μg/L, and 2000 μg/L. The results obtained are detailed below: For the Plantón spring, an approximate concentration of 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene of 19,36 μg/L was obtained in the collected sample, whereas, for the Carlos Calvo spring, the approximate concentration in the collected sample was 1,73 μg/L.
The standard provided by Mr. Clemens Ruepert was used for the determinations in both sampling operations. It should be noted that the standard used is not certified with traceability under the terms of accreditation pursuant to the international standard INTE-ISO/IEC 17025:2017 (nor has a standard satisfying this requirement been found). Additionally, the method used for this determination is not accredited and currently does not yet have the corresponding validation, resulting in little certainty as to the compound’s exact concentration. Nevertheless, the concentrations found exceed the maximum admissible value (valor máximo admisible) established by regulation DE 38924-S. In light of these results, it is necessary and imperative to strengthen the Laboratorio Nacional de Aguas by providing it with physical space, equipment, and supplies to introduce new analyses, such as those for the aforementioned metabolites, in order to maintain adequate monitoring and control.
It is also advisable to establish an interinstitutional commission to analyze the results set forth in this report, take immediate action regarding them, and prepare corrective, preventive, and risk-minimization measures for the population of Cipreses de Oreamuno.” By means of health order (orden sanitaria) n.° CE-ARS-O-OS-4986-2020 of 17 de diciembre de 2021, the respondent authority ordered the president of the ASADA de Cipreses to: “conduct semiannual Fourth-Level (N4) analyses at the Plantón control spring, independently of the analyses that regulations require them to submit semiannually, in order to monitor those parameters at the source, with such analyses to be reviewed in the semiannual drinking-water quality report that must be submitted by the ASADA de Cipreses (…)”. The analysis results were received by the Área Rectora de Salud on 21 de diciembre de 2021, and technical report MS-DRRSCE-DARSO-IT-00028-2022 of 2 de febrero de 2022 stated: “After reviewing the laboratory results, pesticides were detected at trace levels, and degradation products of the fungicide chlorothalonil were present at levels exceeding the limits of the maximum admissible values (…) It is important to obtain support from the Central Level, specifically from Dr. Albin Badilla Mora of Vigilancia y Control de Agua Potable, so that the issue and the next step regarding these degradation products of the fungicide chlorothalonil detected in the aqueduct (acueducto) of the ASADA de Cipreses may be clarified for us.” (Report of the respondent authority and documentary evidence (prueba documental)).
By official letter (oficio) MS-DRRSCE-DARSO-00181-2022 of 7 de marzo de 2022, the respondent Área Rectora de Salud requested that the ASADA de Cipreses include analyses at the distribution-network level in its upcoming pesticide sampling in order to obtain accurate information concerning the entire system; it also requested that it “submit, within 10 business days, the definitive short-term actions that the entity you represent will take to guarantee the supplied population safe, quality water suitable for human consumption (…)”. On 21 de marzo de 2022, the respondent authority held a virtual meeting with Dr. Albin Badilla Mora, a drinking-water expert at the Ministerio de Salud. At that meeting, it was agreed that samples would be collected from the springs and the aqueduct’s distribution network. On 1° de abril de 2022, the petitioner (recurrente), [Nombre 002], filed a complaint with the respondent Área Rectora de Salud regarding the facts at issue in this constitutional proceeding (recurso).
Technical report MS-DRRSCE-DARSO-IT-00124-2022 of 4 de abril de 2022 stated: “RECOMMENDATIONS: Issue a health order to Mr. Virgilio Ulloa Ulloa, president of the ASADA de Cipreses, requiring him to proceed immediately with delimiting the protection zone (zona de protección) of the Plantón Spring and Carlos Calvo Spring (…) Issue a health order to the owners of the surrounding properties who have yet to be served notice (…) requiring them to refrain from actions contrary to public health under the precautionary principle (principio precautorio) and the principles of current regulations; actions carried out within the area established by Ley de Aguas N° 276 that place the water of the Plantón Spring at risk (…) In addition, issue a health order, under the foregoing terms, to the owners of the properties surrounding (…) the Carlos Calvo Spring (…)”. On 6 de abril de 2022, samples were collected from the Carlos Calvo and Plantón Springs, as well as from the distribution network.
Report n.° MS-DPRSA-USA-679-2022 of 28 de abril de 2022 by the Unidad de Salud Ambiental del Ministerio de Salud stated: “RESULTS. As shown in Table 1, the pesticide chlorothalonil was not detected in the samples collected at ASADA Cipreses, either for the Plantón System or the Carlos Calvo System.
It is important to emphasize that this analysis was conducted by a laboratory accredited under the scope of standard INTE-ISO/IEC 17025:2017, as established by Reglamento N° 38924-S (…) the nitrite and nitrate values are within the parameters permitted by Reglamento para la Calidad del Agua Potable n° 38924-S and do not pose a health risk (…) In these specific analyses conducted on both systems at their springs (nacientes), no pesticides were detected, nor was chlorothalonil detected.” By sanitary order (orden sanitaria) of 29 de abril de 2022, the respondent authority ordered ASADA Cipreses to “keep aqueduct personnel involved in monitoring and controlling the boundaries of the springs, continue taking the necessary steps to obtain a hydrogeological study (estudio hidrogeológico) of the area in order to have scientific evidence for taking actions that will lead to greater protection of the water resource, thereby safeguarding it, and conduct pesticide analyses (N4) in the month of Julio del año 2022, including chlorothalonil, at the Plantón and Carlos Calvo Springs, through a laboratory whose testing methods are accredited, in compliance with artículo 10 del Decreto N° 38924-S, Reglamento para la Calidad del Agua Potable y sus Reformas, and submit them to the Área Rectora de Salud de Oreamuno.” On 4 de mayo de 2022, official Albin Badilla Mora sent an email to the Área Rectora de Salud de Oreamuno stating: “I am writing to request your assistance in arranging a meeting via TEAMS with our colleagues from the ARS de Oreamuno, together with the Unidad de Salud Ambiental, to review the case of ASADA de Cipreses, where an alert was issued concerning contamination by products derived from chlorothalonil—1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene and 4-hydroxychlorothalonil—and to learn a little about the position of the LNA and possible actions we may take jointly.” At the meeting of 6 de mayo de 2022, the problem of there being no laboratory in the country that performs metabolite testing was discussed, and it was therefore agreed to schedule a new meeting with the participation of the Laboratorio de Análisis de Residuos de Plaguicidas (LAREP) and the Oficina Regional de Acueductos y Alcantarillados Central Este.
The log of the meeting of 13 de mayo del año en curso recorded: “(…) there is an alert concerning chlorothalonil, but further testing is required to validate the method, validate the matrix, gain some understanding, and ascertain the concentrations and quantities (…)”. It was also agreed to hold another virtual meeting with the Ministerio de Salud and Acueductos y Alcantarillados and to request a technical opinion (criterio técnico) from the Laboratorio Nacional de Aguas regarding the case of ASADA de Cipreses.” Through official letter (oficio) MS-DM-5043-2022 of 3 de junio de 2022, signed by the ministra de Salud and addressed to the presidente ejecutivo del ICAA, the following was stated: “I most respectfully request that you use your good offices to ensure that the measurement analyses in drinking water for the molecules 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene and 4-hydroxychlorothalonil are urgently added to the pesticide panel conducted by the Laboratorio Nacional de Aguas; that these analyses may be conducted as soon as possible on the water of the community of Cipreses de Oreamuno; and that, through the Unidad de Salud Ambiental del Ministerio de Salud, a plan be prepared for measuring these molecules in aqueducts that may have contamination risk factors due to the extensive agricultural activity in this and other areas of the country.” The Área Rectora de Salud de Oreamuno reports that interinstitutional coordination has begun to secure a duly accredited laboratory for the purpose of analyzing chlorothalonil degradation products and thereby confirming or ruling out the presence of these metabolites in the water from the springs in question.” Technical report (informe técnico) n.° MS-DRRSCE-URS-IT-0310-2022 of 18 de octubre de 2022 from the Unidad Rectoría de la Salud de la Dirección Regional Central Este del Ministerio de Salud stated: “I proceeded to request an opinion from Dr. Albin Badilla Mora, Doctor en Microbiología assigned to the Unidad de Salud Ambiental, Dirección de Protección Radiológica y Salud Ambiental del Nivel Central del Ministerio de Salud, who replied via institutional email as follows, and I quote verbatim (…) ‘Chlorothalonil is a fungicide approved for use in the country, registered under a wide variety of names, and used in the farming of various products.
Once the chemical substance comes into contact with the environment, air, soil, and/or microorganisms, it undergoes a series of changes resulting from the metabolism of living organisms or chemical processes that break it down into other molecules known as metabolites or degradation products; in the case of chlorothalonil, there are records of more (sic) than 7 different degradation molecules. In the specific case of the metabolites 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene and 4-hydroxychlorothalonil, little documentation is available, particularly regarding effects on human health, although somewhat more (sic) information exists concerning the environmental and ecotoxic risks of 4-hydroxychlorothalonil. According to a review of chlorothalonil and its international status, the European Union decided in 2019 to prohibit its use because a critical problem was identified concerning groundwater contamination by pesticide metabolites.
The European Authority was unable to rule out a potential genotoxicity concern regarding the residues to which consumers would be exposed and identified a high risk to amphibians and fish for all evaluated uses. Furthermore, chlorothalonil itself is classified as a carcinogen. 1 Conversely, the United States Environmental Protection Agency (EPA) has determined that chlorothalonil products do not pose risks to humans or the environment provided that authorized uses and the instructions on the product label are followed. However, it has stated that there is a lack of studies to determine the risks posed by its metabolites. 2 In conclusion, from a human-health standpoint, there is a shortage of scientific studies characterizing and identifying health risks associated with the consumption, ingestion, or any other form of contact with the metabolites 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene and 4-hydroxychlorothalonil; however, studies do characterize chlorothalonil as highly toxic to aquatic life and moderately toxic to birds and earthworms.
In addition, 4-hydroxychlorothalonil was classified as highly toxic in a study conducted on rodents. 3 Accordingly, any indication of contamination by this pesticide or metabolite must be treated with extreme caution, and the necessary measures must be taken to prevent its ingestion or contact, in view of the limited scientific evidence concerning human health and with reliance on studies confirming its ecotoxicity and the risk to environmental health.’” Through official letter MS-DM-9473-2022 of 20 de octubre de 2022, addressed to the director de la Dirección Regional Rectora de Salud Central Este and the director del Área Rectora de Salud de Oreamuno, the ministra de Salud stated: “Subject: Urgent case requiring attention at ASADA Cipreses de Oreamuno de Cartago (…) you are instructed to urgently coordinate all necessary measures so that: · A sanitary order is issued for the immediate closure of the water sources used by ASADA de Cipreses de Oreamuno for human consumption, specifically the Plantón and Carlos Calvo sources.
In the absence of information characterizing and identifying health risks associated with the consumption, ingestion, or any other form of contact with the metabolites, water from these sources may not be used for human consumption, food preparation, or personal-hygiene activities, pursuant to the precautionary principle (principio precautorio). The use of water from these sources may be considered for flushing toilets and other household cleaning and disinfection activities. · A sanitary order is issued to the Instituto Costarricense de Acueductos y Alcantarillados requiring it to immediately supply (sic) water to the community by tanker trucks or any other mechanism that ensure (sic) the availability of safe water for human consumption among the population of Cipreses. · A sanitary order is issued to ASADA Cipreses and the Instituto Costarricense de Acueductos y Alcantarillados requiring them to communicate accurately and assertively to the community, through as many channels as possible, the situation affecting ASADA Cipreses concerning the metabolites of the pesticide chlorothalonil and the application of the precautionary principle in order to prevent health problems among the population.
It should be noted that the Ministerio de Salud must maintain an oversight role throughout this process. · Through a sanitary order, the Instituto Costarricense de Acueductos y Alcantarillados is required to submit an Action Plan (Plan de Acción) containing short-, medium-, and long-term actions, within a reasonable statutory period, specifying the deadlines to be followed to resolve the contamination situation affecting ASADA Cipreses, whether through interconnections with other ASADAS, the search for new sources, the implementation of treatment systems, or other measures, as determined by its technical governing authority for drinking water. · Through the DRRS Central Este and the ARS de Oreamuno, the local and/or regional office of the Ministerio de Agricultura is requested to take immediate action to identify substitute molecules and ensure good agricultural practices and the proper use of pesticides, particularly chlorothalonil; the measures implemented must be linked to performance indicators so that the results obtained may be measured, monitored, and compared to determine whether contamination has been mitigated and reduced, with a view to remediating the water sources; if MAG cannot implement this action plan, a request to prohibit chlorothalonil must be pursued because of its proven capacity to contaminate water sources and the limited capacity of institutions to measure its metabolites.” Through sanitary order MS-DRRSCE-DARSO-OS-0087-2022 of 20 de octubre de 2022, the Área Rectora de Salud ordered the presidente de la ASADA de Cipreses as follows: “Deadline for compliance with the sanitary order: IMMEDIATELY (…) Proceed with the immediate closure of the water sources used by ASADA de Cipreses de Oreamuno for human consumption, specifically the Plantón and Carlos Calvo sources.
In the absence of information characterizing and identifying health risks associated with the consumption, ingestion, or any other form of contact with the metabolites, water from these sources may not be used for human consumption, food preparation, or personal-hygiene activities, pursuant to the precautionary principle. The use of water from these sources may be considered for flushing toilets and other household cleaning and disinfection activities.
It was also served with sanitary order (orden sanitaria) MS-DRRSCE-DARSO-OS-0091-2022, which provided: “1) Proceed urgently to inform the community of Cipreses, accurately and assertively and through as many channels as possible, of the situation affecting the ASADA DE Cipreses regarding metabolites (metabolitos) of the pesticide Chlorothalonil and the application of the precautionary principle (principio precautorio), for the purpose of preventing health problems among the population, as well as of the provision of water by tanker trucks.” By sanitary order MS-DRRSCE-DARSO-OS-0088-2022 of 20 de octubre de 2022, addressed to the executive president of ICAA, the Área Rectora de Salud de Oreamuno ordered: “Deadline for compliance with the sanitary order: IMMEDIATELY (…) 1) Immediately provide water to the community of Cipreses de Oreamuno by means of tanker trucks or any other mechanism that ensures the availability of safe water for human consumption.
(…)” Likewise, sanitary order MS-DRRSCE-DARSO-OS-0095-2022 was issued, also addressed to the aforementioned agency, ordering: “Deadline for compliance with the sanitary order: 10 calendar days (…) 1) Submit to the Área Rectora de Salud de Oreamuno a Corrective Action Plan (Plan de Acciones correctivas), identifying the person responsible for analyzing the activities and providing a schedule detailing the dates on which the activities will be carried out, with short-, medium-, and long-term actions, within a reasonable statutory period, indicating the steps to be taken to remedy the contamination affecting the ASADA de Cipreses, whether through interconnections with other ASADAS, the search for new sources, the implementation of treatment systems, among other measures, as determined by its technical authority for drinking water (agua potable).” From this perspective, the intervention of this constitutional jurisdiction is necessary.
In this regard, it has been established that the respondent authorities, at least since the previous year, have made efforts to confirm or rule out the presence of pesticides in the Plantón and Carlos Calvo Springs (nacientes) (systems managed by the ASADA de Cipreses de Oreamuno). Accordingly, various studies have been conducted concerning the pesticide chlorothalonil, based on the suspicion that residues might be present in the aforementioned springs. Thus, in report no. MS-DPRSA-USA-679-2022 of 28 de abril de 2022, the Unidad de Salud Ambiental del Ministerio de Salud stated: “RESULTS. As shown in Table 1, the pesticide chlorothalonil was not detected in the samples collected at the ASADA Cipreses, either in the Plantón System or in the Carlos Calvo System (…) These one-time analyses conducted at the springs of both systems did not detect the presence of pesticides, nor was chlorothalonil detected.” However, since December of the previous year, the Laboratorio de Análisis de Residuos de Plaguicidas de la UNA conducted a study in which it detected chlorothalonil degradation products, specifically: “1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene and 4-hydroxychlorothalonil.” Subsequently, during the proceedings in this constitutional case, specifically on 26 de septiembre of the previous year, additional sampling was conducted at the springs in question, and the results report stated: “the samples collected from the two springs in the community of Cipreses (Plantón and Carlos Calvo) were injected, together with five standards of 250 μg/L 500 μg/L, 750 μg/L, 1000 μg/L and 2000 μg/L.
The results obtained are detailed below: For the Plantón spring, an approximate concentration of 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene of 19,36 μg/L was obtained in the collected sample, while for the Carlos Calvo spring, the approximate concentration in the collected sample was 1,73 μg/L. For the determinations in both sampling procedures, the standard provided by Mr. Clemens Ruepert was used. It should be noted that the standard used is not certified with traceability under the Accreditation terms of the international standard INTE-ISO/IEC 17025:2017, (nor has a standard meeting this requirement been found). Additionally, the method used for this determination is not accredited and, at present, the corresponding validation has not yet been obtained, resulting in little certainty regarding the compound’s exact concentration. Nevertheless, the concentrations found exceed the maximum admissible value under regulation DE 38924-S.” Thus, although the respondents state that the studies and results are not accredited under the terms of section 10 of the Reglamento para la Calidad de Agua Potable, it is nonetheless true that the reported metabolite concentrations (19,36 μg/L and 1,73 μg/L) are a clear indication of a contamination problem, since the values substantially exceed the maximum permitted by ordinary regulations (which is 0.1 μg/L). Indeed, health order no. MS-DRRSCE-DARSO-OS-0087-2022 provided that these water sources could not be used for consumption, food preparation, or personal hygiene activities.
Now, although the respondents had known of the presence of metabolites in the referenced springs since the first study conducted at the end of the previous year, it was not until the second sampling procedure (conducted during the processing of this constitutional protection action (recurso de amparo)) that specific measures were taken, without any definitive solution to the situation in question having been established.
Accordingly, although the health orders issued on 20 de octubre of the current year directed the immediate closure of the Plantón and Carlos Calvo sources of the ASADA de Cipreses, notification of the situation to the community of Cipreses de Oreamuno, the supply of water to that community by tanker trucks, and the preparation of a corrective plan, it is nonetheless true that these actions constitute provisional measures, whereas the situation at issue in the case under review (sub iudice) warrants a comprehensive and definitive solution within a reasonable period.
From this perspective, considering that the respondents had been alerted since December of the previous year to a contamination problem in the springs in question; that this situation had been formally reported by the petitioner since April of the current year; that the most recent sampling detected metabolite concentrations exceeding the maximum value permitted by ordinary regulations; and that the State is required to implement the measures necessary for the effective protection of the environment and human health, this Court grants the action so that, within a maximum period of three months from service of this judgment, the respondents undertake the relevant coordination and actions, within the framework of a joint plan, to comprehensively and definitively resolve the chlorothalonil-metabolite contamination affecting the Plantón and Carlos Calvo springs of the ASADA de Cipreses de Oreamuno. Furthermore, within the aforementioned period, they must investigate whether the contamination problem in the aforementioned springs has affected other communities. In the interim, the authorities must guarantee the supply of drinking water to the affected communities by tanker trucks or another alternative.
Possible deficiencies in preventive and oversight policies concerning water potability.
The situation raised by the petitioners in this amparo proceeding is a warning to the authorities responsible for drinking-water services, health, and the environment. There is a serious deficiency in the capacity of the competent laboratories to detect certain substances released into the environment and marketed for agricultural or industrial use. A reading of the facts and findings concerning an issue as delicate as the contamination of water for human consumption raises various unanswered questions. This uncertainty is serious when health and the environment are at stake. It is in the context of summary amparo proceedings that serious limitations have been identified in the intervention of the competent authorities responsible for protecting the environment and human health. So many questions remain unanswered in this summary inquiry, while it is clearly acknowledged that the material and institutional resources needed to detect toxic substances in water intended for human consumption are unavailable. This is acknowledged by the very institution charged with fulfilling this mission. From the decision I join, I emphasize the following facts:
1-On 4 de mayo de 2022, official Albin Badilla Mora sent an email to the rea Rectora de Salud de Oreamuno, in which he stated: “I am writing to request your assistance in arranging a meeting via TEAMS with the staff of the ARS de Oreamuno and the Unidad de Salud Ambiental to review the case of the ASADA de Cipreses, where an alert was issued regarding contamination by the chlorothalonil-derived products 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene and 4-hydroxychlorothalonil, and to learn more about the LNA’s position and possible actions that we may take jointly.” (Report of the respondent authority and documentary evidence).
2-At the meeting of 6 de mayo de 2022, the problem of the country’s lack of a laboratory capable of testing for the metabolites was presented, and it was therefore agreed to schedule a new meeting with the participation of the Laboratorio de Análisis de Residuos de Plaguicidas (LAREP) and the Oficina Regional de Acueductos y Alcantarillados Central Este. (Report of the respondent authority).
3-The log of the meeting of 13 de mayo of the current year stated: “(…) there is an alert concerning chlorothalonil, but further testing is required to validate the method, validate the matrix, gain a better understanding, and obtain certainty regarding the concentrations and quantities (…)”. It was likewise agreed to hold another virtual meeting with the Ministerio de Salud and Acueductos y Alcantarillados and to request a technical opinion from the Laboratorio Nacional de Aguas concerning the case of the ASADA de Cipreses.” (Report of the respondent authority and documentary evidence).
4-By official letter MS-DM-5043-2022 of 3 de junio de 2022, signed by the ministra de Salud and addressed to the executive president of the ICAA, it was stated: “I most respectfully request that you use your good offices so that measurements in drinking water of the molecules 1,3-dicarbamoyl-2,4,5,6-tetrachlorobenzene and 4-hydroxychlorothalonil are urgently added to the pesticide panel used by the Laboratorio Nacional de Aguas; that these analyses may be performed as soon as possible on the water of the community of Cipreses de Oreamuno; and that, through the Unidad de Salud Ambiental del Ministerio de Salud, a plan be prepared to measure these molecules in aqueducts that may be exposed to contamination risk factors because of the extensive agricultural activity in this and other areas of the country.” (Documentary evidence).
The warning regarding toxic substances is not recent; several months have passed amid inaction and unanswered questions, revealing insurmountable limitations acknowledged by local and national institutions. This case may be representative of what is occurring in other communities and territories of the country—situations in which the authorities are unable to discharge their essential responsibilities, and citizens must apply to this jurisdiction to ask questions that remain out of sight because of resource constraints and bureaucratic inertia. The country does not have a laboratory capable of testing for the metabolites—what a deeply troubling conclusion, acknowledged by the respondents. According to the competent authorities, the reports of the Universidad Nacional constitute an alert and nothing more. Calling it an alert says little; I believe it is more than an alert—it is a troubling acknowledgment of the inability to provide a satisfactory response to the persons who filed the amparo action.
This case illustrates the inability of the health authority and the drinking-water service to take effective preventive action to safeguard public health. Reading the reports of the respondent entities, I wonder about the danger that the use of a substance such as Cloratalonil poses to the environment and human health. This question is one of the troubling issues amid so many uncertainties and omissions. So much remains to be done in matters as delicate and important to the public as drinking water and the protection of a healthy and ecologically balanced environment. Fiscal constraints and the rules governing them must not weaken such relevant and fundamental matters. This case is an example of that: the postponement of health and environmental protection.
In environmental matters, it is the undersigned’s position that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative jurisdiction (jurisdicción administrativa). Nevertheless, I do address the merits of the matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as occurs in this case, in which it is alleged that the respondent authorities have failed to fulfill their duty to protect health and the environment, because they have not yet put an end to the alleged water-contamination problem caused by the use of a pesticide, which threatens to infringe the right to enjoy a healthy and ecologically balanced environment and a decent quality of life.
Although I agree with the majority of the Chamber that the amparo petition (recurso de amparo) should be granted, I disagree as to where the enforcement phase of the matter should be assigned, due to the absence of adequate mechanisms under the rules governing this constitutional jurisdiction (jurisdicción constitucional) for monitoring compliance with a judgment involving highly complex technical aspects, as in this case, in which the relevant coordination and actions must be undertaken in order to complete all technical studies necessary to obtain results that establish or rule out, with a reasonable degree of certainty, pesticide contamination in the Plantón and Carlos Calvo springs (nacientes) belonging to the ASADA de Cipreses de Oreamuno. Likewise, if contamination in those springs is determined with a reasonable degree of certainty, the relevant coordination and actions must be undertaken, within the framework of a joint plan, to resolve the situation comprehensively and definitively.
By contrast, the provisions of the Code of Administrative Litigation Procedure (Código Procesal Contencioso-Administrativo) concerning enforcement (Article 155 et seq.) offer clear advantages, such as the possibility of requiring schedules, imposing fines, determining liability, overseeing stages of compliance, etc. Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase must take place before the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.
The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be retrieved from the court office within a maximum period of 30 business days from notification of this judgment. Por tanto:
The petition is granted. Eric Alonso Bogantes Cabezas and María José Lafuente González, respectively general manager of the Instituto Costarricense de Acueductos y Alcantarillados and acting director of the Área Rectora de Salud de Oreamuno, or whoever respectively holds those positions, are ordered to issue the appropriate directives and carry out all actions falling within their respective areas of authority so that, within a maximum period of THREE MONTHS from notification of this judgment, the relevant coordination and actions are undertaken, within the framework of a joint plan, to: 1) resolve comprehensively and definitively the contamination by chlorothalonil metabolites in the Plantón and Carlos Calvo springs belonging to the ASADA de Cipreses de Oreamuno; and 2) investigate whether the contamination problem in the aforementioned springs has harmed other communities in the area. In the interim, the aforementioned authorities must guarantee the supply of drinking water to the affected communities by tanker trucks or another alternative.
This order is issued with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that the person must comply with or enforce, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State and the Instituto Costarricense de Acueductos y Alcantarillados are ordered to pay the legal costs, damages, and losses caused by the events underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation jurisdiction (jurisdicción contencioso-administrativa). Recurso de amparo que se tramita en el expediente n.° 22-015651-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], [Nombre 002], cédula de identidad [Valor 002] , [Nombre 003] , cédula de identidad [Valor 003] , [Nombre 004] , cédula de identidad [Valor 004], [Nombre 005], cédula de identidad [Valor 005], [Nombre 006], cédula de identidad [Valor 006], y [Nombre 007] , cédula de identidad [Valor 007], contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA) y el MINISTERIO DE SALUD.
Resultando:

En dicha reunión se toman los siguientes acuerdos, los cuales se transcriben textualmente de bitácora anexa, remitida vía correo electrónico por el Ministerio de Salud: 1. Procesamiento de muestras que se recolectaran en ASADA de Santa Rosa 2. Coordinar entrega de materiales para muestreo 3. Acompañamiento y seguimiento de muestreo en la ASADA de Santa Rosa 4. Entrega de informes de resultados LNA - IRET 5. Coordinaciones internas ante una posible intervención del sistema de abastecimiento de agua Se va a continuar con muestreos en las ASADAS de la zona norte de Cartago para determinar la presencia de metabolitos de Clorotalonil, de manera que se pueda realizar una valoración integral de las potenciales fuentes alternativas.”Conforme lo solicitado por la honorable Sala Constitucional como prueba para mejor resolver.”.
Redacta el Magistrado Rueda Leal ; y,
Considerando:
La coadyuvancia es una forma de intervención adhesiva que se da, cuando una persona actúa en un proceso, adhiriéndose a las pretensiones de algunas de las partes principales. En consecuencia, está legitimado para actuar como coadyuvante quien ostente un interés directo en el resultado del recurso; sin embargo, al no ser actor principal, el coadyuvante no resultará directamente afectado por la sentencia, es decir, la eficacia de ésta no podrá alcanzarle de manera directa e inmediata, ni le afecta la condición de cosa juzgada del pronunciamiento (véanse, entre otras, las sentencias n.°2010-000254, de las 11:28 horas el 08 de enero de 2010, y la n.° 2018019952 de las 9:30 horas de 30 de noviembre de 2018). En este caso, la Sala procede a admitir las coadyuvancias presentadas por cuanto los solicitantes sí tienen un interés en el resultado de este proceso.
Los recurrentes manifiestan que las nacientes de Platón y Carlos Calvo, de la ASADA de Cipreses de Oreamuno de Cartago, presentaron resultados positivos de plaguicidas según fue reconocido por el Instituto Costarricense de Acueductos y Alcantarillados, de acuerdo a un estudio del Instituto Regional de Estudios en Sustancias Tóxicas (IRET) de la Universidad Nacional. Agregan que el informe UNA-LAREP-OFIC-060-2021-S20-13-05-2021 del 17 de diciembre de 2021, del IRET, se menciona la presencia de productos de la degradación del plaguicida clorotalonil, así como trazas de 9 plaguicidas varios en el agua de las referidas nacientes. Afirman que la situación es de conocimiento del Ministerio de Salud, según consta en el informe técnico MS-DRRSCE-DARSO-IT-00312-2021. Apunta que los resultados positivos de contaminación fueron presentados desde el 2021 al Ministerio de Salud y a la ASADA de Cipreses de Oreamuno de Cartago, pero no se tomaron las medidas correspondientes en protección a la salud pública ni ambiental.
Precisan que desde el 1° de abril de 2022, se presentaron las denuncias por escrito al Área Rectora de Salud de Oreamuno del Ministerio de Salud y a la Gerencia General del Instituto Costarricense de Acueductos y Alcantarillados, donde se solicitó que se dispusiera agua libre de contaminantes agrotóxicos en cisternas amparados en el principio precautorio, se realizaran los análisis para mantener el monitoreo constante de los productos de degradación del clorotalonil de forma periódica, se les entregara los resultados del monitoreo de plaguicidas e hicieran públicos y el cuido de las áreas de protección de las tomas de agua de la comunidad. Señalan que, en respuesta de las denuncias, el Laboratorio Nacional de Aguas del ICAA hizo un análisis de agua para unos plaguicidas, pero omitió referirse sobre la presencia de los subprocesos específicos de clorotalonil y no analizaron ni reportaron los compuestos “3-dicarbomoil-2,4,5, tetraclorobenceno y el 4-hidroxiclorotalonil ”, a pesar de ello aseveraron públicamente que el agua es potable. Enfatizan que el IRET de la Universidad Nacional, el Ministerio de Salud y el mismo Instituto Costarricense de Acueductos y Alcantarillados han reconocido la contaminación del agua.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
En cuanto al ICAA:
De acuerdo con todo lo anterior se concluye que aún no es posible tomar estos análisis como concluyentes en lo relacionado con el Reglamento para la Calidad del Agua Potable N° 38924-S, sin que esto sea impedimento para que la ORAC tome las medidas preventivas/correctivas que considere pertinentes.”. No obstante, el gerente general del ICAA informa: “ la Institución continúa realizando las investigaciones para realizar colaboración con algún laboratorio a nivel nacional o internacional para poder determinar con base científica, y en cumplimiento de los Reglamentos aplicables a la materia, la presencia de metabolitos de Clorotalonil.”. (Informe de la autoridad recurrida y prueba documental).
En este sentido, desde la Oficina Regional Central Este en coordinación con la ASADA se estarán realizando visitas periódicas para la verificación de las áreas de protección y ante la detección de alteraciones se estará comunicando al Ministerio de Salud para que tome las medidas correspondientes. No es correcto afirmar que no se han realizado acciones para proteger el agua, adicionalmente a los procesos que se describen en el HECHO OCTAVO, desde la Subgerencia de Gestión de Sistemas Delegados, para abordar la problemática presentada y tomar acciones puntuales de mitigación se formuló un Plan de Seguridad del Agua (anexo 2) El objetivo del Plan de Acción es plantear e implementar un Sistema Integral Gestión del Riesgo para la ASADA de Cipreses de Oreamuno y de esta manera identificar y evaluar los riesgos en todo el proceso de la prestación de servicio, con lo cual se podrán definir las acciones para mitigarlos.
Para este fin la Subgerencia de Gestión de Sistemas Delegados, colaborará y dará acompañamiento metodológico para el desarrollo e implementación del Plan de Seguridad del Agua (PSA), basada en le metodología institucional.”. (Prueba documental).
Se está realizando un seguimiento especial para poder subsanar por parte de los consultores contratados por la ASADA los informes entregados al AyA debido a que a la fecha estos insumos técnicos no cumplen lo requerido por esta dependencia Institucional. Adicionalmente la ASADA ha solicitado se realice por parte de la UEN Gestión Ambiental del AyA, un estudio hidrogeológico para la delimitación del área de protección especial de las nacientes Carlos Calvo y Plantón (anexo 3), ante lo cual se está reuniendo por parte del ente operador los requisitos, incluyendo la autorización de las personas propietarias para el ingreso de los hidrogeólogos del AyA para realizar los análisis correspondientes. El Ministerio de Salud ha girado órdenes sanitarias a las personas propietarias que realizaban labores de agricultura en cercanía de la naciente Plantón (anexo 4), por lo que ya existen medidas de restricción ejecutadas por otras Instituciones del Estado en apoyo a la gestión del caso de potencial contaminación.
Una vez se cuente con los estudios subsanados y aprobados por la UEN Gestión Ambiental, al haberse determinado el comportamiento hidrogeológico de las nacientes, la zona de recarga y zona de protección, se podrán tomar medidas específicas para realizar una gestión integral de protección del recurso hídrico y las áreas de cobertura boscosa requeridas para que se mantenga su cantidad y calidad (…)”. (Prueba documental).
En el caso de la ASADA Santa Rosa de Oreamuno, el 15 de febrero de 2021 se rindió informe según acuerdo de Junta Directiva del AyA N°2007-350 “Procedimiento para asumir sistemas de acueductos y alcantarillados por AyA” mediante oficio GSD-UENGAR-2021-00641 (Anexo). En este informe se detalla la información sobre la factibilidad técnica de la operación de este ente operador del área de cobertura actualmente asignado a la ASADA Cipreses de Oreamuno, sin embargo, no se valoró una clausura total de las nacientes Plantón y Carlos Calvo debido a que se carecía de los datos específicos sobre contaminación con metabolitos de Clorotalonil. En un análisis reciente se identifica que es necesario incrementar la capacidad hidráulica de la tubería del sector 3 y realizar mejoras importantes en una interconexión entre ambos sistemas (Cipreses y Santa Rosa) construida en 1914. De acuerdo con información suministrada por el equipo de ingeniería de la ORAC los trabajos de mejoras para poder tener una interconexión con suficiente capacidad hidráulica tomarían unos 3 meses.
El día 18 de octubre se realizó en colaboración con el Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional (IRET-UNA) un muestreo de las nacientes de dos sistemas de la ASADA Santa Rosa de Oreamuno, para valorar la calidad de agua en relación con la presencia de metabolitos del fungicida Clorotalonil. Este muestreo se deriva de los acuerdos tomados en la reunión sostenida en el Laboratorio Nacional de Aguas el día 17 de octubre, ante la confirmación por parte esta instancia Institucional de la contaminación con estos compuestos sobre el nivel establecido por la norma. En el caso de la ASADA San Pablo, no se cuentan con suficientes datos. Es necesario valorar el balance hídrico y la capacidad hidráulica debido a que este ente operador carece de Estudio Técnico, el cual debe ser actualizado de manera integral de acuerdo con el Reglamento de ASADAS. Se tiene planificado realizar un muestreo completo de las fuentes para descartar la presencia de Clorotalonil y sus metabolitos, así como una revisión completa del perfil de calidad.
Por su parte la ASADA Cipreses de Oreamuno debe realizar varias obras importantes para mejorar su capacidad hidráulica, como se deriva de estudio realizado por parte de Centro de investigación en Vivienda Y Construcción del Instituto Tecnológico de Costa Rica, para lo cual se les ha pedido priorización, costos y tiempo estimado de ejecución. Es posible que el presupuesto disponible por parte de la ASADA Cipreses de Oreamuno no sea suficiente para cubrir las obras necesarias a mediano plazo. A la fecha no existe factibilidad técnica para la interconexión inmediata en ninguno de los sistemas de abastecimiento circundantes, administrados por ASADAS o alguna Municipalidad. Se recomienda una actualización del informe Según acuerdo de Junta Directiva del AyA N°2007-350 “Procedimiento para asumir sistemas de acueductos y alcantarillados por AyA” mediante el cual debe realizarse un análisis profundo de gestión e infraestructura, valorando la clausura de las fuentes asignadas a Cipreses de Oreamuno y las implicaciones en el balance hídrico y la capacidad hidráulica de ambos sistemas.”. Para llevar a cabo dicho proyecto se discutió aspectos técnicos en reunión con el Sr. Clemens Ruepert, funcionario del IRET, quien mencionó la posibilidad de llevar a cabo la determinación del metabolito 1,3-dicarbamoyl-2,4,5,6-tetraclorobenceno por la técnica de cromatografía de gases (GC-MS) en el Laboratorio Nacional de Agua (LNA), a pesar de que finalmente ellos obtuvieron mejores resultados por la técnica de HPLC-MS. Con respecto al metabolito 4-hidroxiclorotalonil, por experiencia adquirida del IRET se determinó que la técnica de cromatografía de gases no es la apropiada siendo la cromatografía líquida ( HPLC-MS), la idónea. Como parte de las acciones de colaboración en conjunto, el IRET ofreció y suministró al LNA de un patrón de 1,3-dicarbamoyl-2,4,5,6-tetraclorobenceno, además de los cartuchos de extracción usados por este laboratorio en las determinaciones de dicho metabolito, de modo que el LNA pudiera hacer las pruebas correspondientes y determinar si por la técnica GC-MS es posible detectar dicho metabolito.
El LNA realizó las siguientes tareas usando el patrón de metabolito aportado por el IRET: 1. Se llevó a cabo un estudio de barrido (usando una concentración alta, ppm) para determinar si el equipo logra detectar el compuesto y determinar el tiempo de retención de este. Este estudio obtuvo buenos resultados por cuanto fue posible detectar el metabolito. 2. De acuerdo con la experticia de los técnicos del LNA, se diseñó un método nuevo, con las condiciones cromatográficas de temperatura, tiempo y gradiente. Este estudio requirió de varios ajustes, hasta obtener un método con mejor forma de pico cromatográfico. 3. Se realizó un estudio tipo Auto SRM, para determinar las transiciones másicas y las energías de ionización que generaran los mejor resultados en cuanto a intensidad del pico cromatográfico. 4. Se realizó una gran cantidad de pruebas, variando condiciones del equipo, concentraciones de metabolito y disolventes, revisando en cada caso, las variaciones en el tiempo de retención y las condiciones espectrométricas del análisis. 5.
Para llevar a cabo una optimización adicional, se realizó una reunión virtual, el día 9 de setiembre de 2022, con el Sr. Clemens Ruepert lo anterior con la finalidad de una posible cooperación entre las instituciones y para exponerle los datos metodológicos y resultados, y obtener retroalimentación y recomendaciones. 6. Se aplicaron las recomendaciones referentes a las rampas de calentamiento, según lo indicado por el Sr. Ruepert y se procedió a realizar nuevas pruebas con distintas concentraciones de patrón. Por otro lado, el LNA llevó a cabo, la toma de muestras en la naciente Plantón y la naciente Carlos Calvo, el día 23/8/2022 (AyA-OT-2203554), con el fin de realizar pruebas en el desarrollo de la metodología del análisis del metabolito 1,3-dicarbamoyl-2,4,5,6-tetraclorobenceno, encontrando sospechas de la presencia del metabolito, pero requiriendo aun un mayor desarrollo del método.
De acuerdo con el estudio realizado con el patrón suministrado, se obtuvo que la técnica de GC-MS, si bien permite la detección del metabolito 1,3-dicarbamoyl-2,4,5,6-tetraclorobenceno, posee limitaciones en cuanto a la sensibilidad, ya que la concentración mínima que puede cuantificarse del patrón fue 250 μg/L. Esto implica que, aplicando el pre-tratamiento de muestra actual, el límite de cuantificación del método sería como mínimo 0,63 μg/L, siendo necesario por reglamentación del país obtener valores de 0,1 μg/L o menos. Adicionalmente con la finalidad de optimizar el método, se acordó realizar una nueva toma de muestras en conjunto con el IRET en la comunidad de Cipreses para poder realizar un proceso de pruebas con muestras recientes. Dicho muestreo se llevó a cabo el día 26/9/2022, AYA-OT-2203999 y en el mismo, se tomaron muestras para ser procesadas en el LNA y muestras para ser procesadas en el IRET.
Muestras tomadas el 26/09/2022. Con las limitaciones de sensibilidad del método en desarrollado, se procedió a realizar la inyección de las muestras recolectadas en las dos nacientes de la comunidad de Cipreses (Plantón y Carlos Calvo), así como cinco patrones de 250 μg/L 500 μg/L, 750 μg/L, 1000 μg/L y 2000 μg/L. A continuación, se detallan los resultados obtenidos: Para la naciente Plantón se obtuvo una concentración aproximada de 1,3- dicarbamoyl-2,4,5,6-tetraclorobenceno de 19,36 μg/L en la muestra recolectada, mientras que, para la naciente Carlos Calvo, la concentración aproximada fue de 1,73 μg/L en la muestra recolectada. Para las determinaciones en ambos muestreos se utilizó el patrón facilitado por el Sr. Clemens Ruepert. Cabe destacar que el patrón usado no es certificado con trazabilidad bajo los términos de Acreditación en la norma internacional INTE-ISO/IEC 17025:2017, (ni se ha encontrado un patrón que cumpla con esto).
Adicionalmente, el método utilizado para esta determinación no se encuentra acreditado, y de momento aún no se posee la validación correspondiente, generando poca certeza en la concentración exacta del compuesto. Sin embargo, las concentraciones encontradas son superiores al valor máximo admisible del reglamento DE 38924-S. Con estos resultados, se vuelve necesario e imperante fortalecer al Laboratorio Nacional de Aguas con el fin de dotarlo de espacio físico, equipos e insumos para introducir nuevos análisis como es el caso de los metabolitos supracitados a fin de mantener una vigilancia y control adecuado; además es recomendable la integración de una comisión interinstitucional que lleve a cabo un análisis de los resultados expuestos en este informe, tome acciones inmediatas de los mismos y prepare acciones correctivas, preventivas y de minimización de riesgos en la población de Cipreses de Oreamuno.”. (Prueba documental).
En cuanto al Área Rectora de Salud:
Para el caso específico de los metabolitos 1,3-dicarbamoil-2,4,5,6 tetraclorobenceno y el 4-hidroxiclorotalonil existe poca documentación disponibilidad, en especial sobre la afectación para la salud humana, existiendo un poco mas (sic) de información sobre riesgos ambientales y ecotóxicos para el 4- hidroxiclorotalonil. Según revisión del caso del químico clorotalonil y su estatus internacional en la Unión Europea se decidió en el 2019 prohibir su uso porque se identificó un problema crítico en relación con la contaminación de las aguas subterráneas por los metabolitos del plaguicida. La Autoridad Europea no pudo descartar un posible problema de genotoxicidad de los residuos a los que se verían expuestos los consumidores y detectó un alto riesgo para los anfibios y los peces en todos los usos evaluados. Asimismo, el clorotalonil, como tal, está clasificado como carcinógeno. 1 Por otro lado, la Agencia de Protección Ambiental de los Estados Unidos (EPA) ha determinado que los productos del clorotalonil no suponen riesgos para los seres humanos o el medio ambiente mientras que se sigan los usos autorizados y las indicaciones de la etiqueta del producto.
Sin embargo, ha declarado que existe un faltante de estudios para determinar riesgos por sus metabolitos. 2 En conclusión, desde el punto de vista de salud humana existe una deficiencia en estudios científicos que caractericen e identifiquen riesgos asociados a la salud por el consumo, ingesta o cualquier otro tipo de contacto de los metabolitos 1,3-dicarbamoil-2,4,5,6 tetraclorobenceno y el 4- hidroxiclorotalonil, sin embargo sí existen estudios que caracterizan al clorotalonil como altamente tóxico para la vida acuática y moderadamente tóxico en aves y lombrices. Además, se ha tipificado al 4- hidroxiclorotalonil como altamente tóxico en un estudio realizado en roedores. 3 Por lo que se debe de considerar con extrema precaución cualquier indicio de contaminación con este plaguicida o metabolito y tomar las medidas necesarias para evitar su ingesta o contacto en vista de la poca evidencia científica que existe referente a la salud humana y apoyarse en los estudios que confirman la ecotoxicidad que presenta, así como el riesgo para la salud ambiental.”. (Prueba documental).
Se puede considerar el uso del agua de estas fuentes para el funcionamiento de inodoros y otras actividades de limpieza y desinfección intradomiciliaria. · Se emita una Orden Sanitaria al Instituto Costarricense de Acueductos y Alcantarillados para que se brinden (sic) agua a la comunidad de manera inmediata por medio de camiones cisterna o cualquier otro mecanismo que aseguro (sic) disponibilidad de agua segura para consumo humano en la población de Cipreses. · Se emita una Orden Sanitaria a la ASADA Cipreses y al Instituto Costarricense de Acueductos y Alcantarillados para que se comuniquen a la comunidad de manera correcta y asertiva, así como por la mayor cantidad de canales posibles la situación que presenta la ASADA Cipreses sobre los metabolitos del plaguicida Clorotalonil y la aplicación del principio de precaución con el fin de prevenir problemas de salud en la población. No se omite manifestar que el Ministerio de Salud debe de cumplir un rol vigilante de este proceso. · Solicitar mediante Orden Sanitaria un Plan de Acción con acciones a corto, mediano y largo plazo al Instituto Costarricense de Acueductos y Alcantarillados en un plazo considerable de ley donde se indique los plazos a seguir para solucionar la situación de contaminación de la ASADA Cipreses, ya sea mediante interconexiones con otras ASADAS, búsqueda de nuevas fuentes, aplicación de sistemas de tratamiento entre otras, según sea determinado por su rectoría técnica en el agua potable. · Se le solicite mediante la DRRS Central Este y el ARS de Oreamuno a la oficina local y/o regional del Ministerio de Agricultura que efectúe acciones inmediatas con el fin de buscar moléculas sustitutas, asegurar las buenas prácticas agrícolas y uso correcto de plaguicidas, en especial de clorotalonil; que las acciones aplicadas estén articuladas con indicadores de desempeño con el fin de poder medir, monitorear y comparar los resultados obtenidos que determinen una mitigación y disminución de la contaminación a fin de obtener un saneamiento de las fuentes de agua; en caso de que el MAG no pueda poner en práctica este plan de acciones de debe proceder con una solitud de prohibición del clorotalonil, debido a su probada capacidad de contaminar fuentes y la poca capacidad de las instituciones para poder medir sus metabolitos.”. (Prueba documental).
aa) Por medio de la orden sanitaria MS-DRRSCE-DARSO-OS-0087-2022 de 20 de octubre de 2022, el Área Rectora de Salud le ordenó al presidente de la ASADA de Cipreses lo siguiente: “Plazo de cumplimiento de la orden sanitaria: INMEDIATAMENTO (…) Proceder a la clausura inmediata de las fuentes de agua para consumo humano que utiliza la ASADA de Cipreses de Oreamuno, en específico las fuentes Plantón y Carlos Calvo. Ante la ausencia de información que caracterice e identifique riesgos asociados a la salud por el consumo, ingesta o cualquier otro tipo de contacto de los metabolitos el agua de estas fuentes no podrá ser utilizada para consumo humano, preparación de alimentos y actividades higiene corporal como parte de un principio precautorio. Se puede considerar el uso del agua de estas fuentes para el funcionamiento de inodoros y otras actividades de limpieza y desinfección intradomiciliaria”.
También se le notificó la orden sanitaria MS-DRRSCE-DARSO-OS-0091-2022, en la que se dispuso: “1) Proceder a comunicarle urgentemente a la comunidad de Cipreses de manera correcta y asertiva, así como por la mayor cantidad de canales posibles la situación que presenta la ASADA DE Cipreses, sobre los metabolitos del plaguicida Clorotalonil y la aplicación del principio precautorio, con la finalidad de prevenir problemas de salud en la población, así como el suministro del agua por medio de cisternas.”. (Prueba documental).
bb) Mediante la orden sanitaria MS-DRRSCE-DARSO-OS-0088-2022 de 20 de octubre de 2022, dirigida al presidente ejecutivo del ICAA, el Área Rectora de Salud de Oreamuno dispuso: “Plazo de cumplimiento de la orden sanitaria: INMEDIATAMENTE (…) 1) Brindar agua a la comunidad de Cipreses de Oreamuno, de manera inmediata, por medio de camiones cisterna o cualquier otro mecanismo, que asegure disponibilidad de agua segura para consumo humano. (…)”. Asimismo, se emitió la orden sanitaria MS-DRRSCE-DARSO-OS-0095-2022, también dirigida a la dependencia aludida, en la que se ordenó: “Plazo de cumplimiento de la orden sanitaria: 10 días naturales (…) 1) Presentar ante el Área Rectora de Salud de Oreamuno, un Plan de Acciones correctivas indicando el responsable de analizar las actividades y el cronograma donde se detallen las fechas de la realización de las actividades, con acciones a corto, mediano y largo plazo, en un plazo considerable de ley donde se indique los pasos a seguir para solucionar la situación de contaminación de la ASADA de Cipreses, ya sea mediante interconexiones con otras ASADAS, búsqueda de nuevas fuentes, aplicación de sistemas de tratamiento entre otras, según sea determinado por su rectoría técnica en el agua potable.”. (Prueba documental).
En reiteradas ocasiones, la jurisprudencia de esta Sala ha subrayado que el derecho a un ambiente sano y ecológicamente equilibrado se encuentra reconocido tanto a nivel constitucional como convencional. Asimismo, se ha indicado que la protección efectiva a ese derecho requiere que los recursos sean utilizados de manera racional, contexto en que el Estado y la ciudadanía en general deben actuar según los principios que rigen la materia ambiental. En este orden de ideas, la doctrina especializada ha señalado que el principio preventivo demanda que, cuando haya certeza de posibles daños al ambiente, la actividad afectante deba ser prohibida, limitada, o condicionada al cumplimiento de ciertos requerimientos. En general, este principio aplica cuando existen riesgos claramente definidos e identificados al menos como probables; asimismo, tal principio resulta útil cuando no existen informes técnicos o permisos administrativos que garanticen la sostenibilidad de una actividad, pero hay elementos suficientes para prever eventuales impactos negativos.
Por otra parte, el principio precautorio señala que, cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente. De lo anterior, se advierte que el principio parte de una incertidumbre científica razonable en conjunto con la amenaza de un daño ambiental grave e irreversible. En términos generales, una diferencia relevante entre el principio preventivo y el precautorio radica en el nivel de conocimiento y certeza de los riesgos que una actividad u obra provoque. Mientras que en el primero existe tal certeza, en el segundo lo que se advierte es un estado de duda resultado de informaciones científicas o estudios técnicos. Así, el Estado costarricense se encuentra obligado a adoptar las medidas que garanticen la defensa y preservación efectiva del ambiente conforme a tales principios.
Ahora, tal obligación objetiva no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los órganos jurisdiccionales, que se tome una medida determinada, pero sí a que se adopten las que sean idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades, o bien, de personas físicas y jurídicas, conforme la reconocida teoría de la eficacia horizontal de los derechos fundamentales (Drittwirkung der Menschenrechte), entre cuyas manifestaciones procesales se encuentra el amparo contra sujetos de derecho privado.
En el sub lite, los recurrentes manifiestan que las nacientes de Platón y Carlos Calvo, de la ASADA de Cipreses de Oreamuno de Cartago, presentaron resultados positivos de plaguicidas según fue reconocido por el Instituto Costarricense de Acueductos y Alcantarillados, de acuerdo a un estudio del Instituto Regional de Estudios en Sustancias Tóxicas (IRET) de la Universidad Nacional. Agregan que el informe UNA-LAREP-OFIC-060-2021-S20-13-05-2021 del 17 de diciembre de 2021, del IRET, se menciona la presencia de productos de la degradación del plaguicida clorotalonil, así como trazas de 9 plaguicidas varios en el agua de las referidas nacientes. Afirman que la situación es de conocimiento del Ministerio de Salud, según consta en el informe técnico MS-DRRSCE-DARSO-IT-00312-2021. Apunta que los resultados positivos de contaminación fueron presentados desde el 2021 al Ministerio de Salud y a la ASADA de Cipreses de Oreamuno de Cartago, pero no se tomaron las medidas correspondientes en protección a la salud pública ni ambiental.
Precisan que desde el 1° de abril de 2022, se presentaron las denuncias por escrito al Área Rectora de Salud de Oreamuno del Ministerio de Salud y a la Gerencia General del Instituto Costarricense de Acueductos y Alcantarillados, donde se solicitó que se dispusiera agua libre de contaminantes agrotóxicos en cisternas amparados en el principio precautorio, se realizaran los análisis para mantener el monitoreo constante de los productos de degradación del clorotalonil de forma periódica, se les entregara los resultados del monitoreo de plaguicidas e hicieran públicos y el cuido de las áreas de protección de las tomas de agua de la comunidad. Señalan que, en respuesta de las denuncias, el Laboratorio Nacional de Aguas del ICAA hizo un análisis de agua para unos plaguicidas, pero omitió referirse sobre la presencia de los subprocesos específicos de clorotalonil y no analizaron ni reportaron los compuestos “3-dicarbomoil-2,4,5, tetraclorobenceno y el 4-hidroxiclorotalonil”, a pesar de ello aseveraron públicamente que el agua es potable. Enfatizan que el IRET de la Universidad Nacional, el Ministerio de Salud y el mismo Instituto Costarricense de Acueductos y Alcantarillados han reconocido la contaminación del agua.
Del estudio de los autos se tiene por demostrado, que, el Laboratorio de Análisis de Residuos de Plaguicidas del Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional (UNA), mediante el oficio n.° UNA-LAREP-OFIC-060-2021-S20-13-05-2021 de 17 de diciembre de 2021, dirigido a la ASADA de Cipreses de Oreamuno, indicó: “Le adjunto el informe con los resultados del análisis de residuos de plaguicidas en las muestras de agua tomadas el 26 de octubre 2021 en las nacientes Carlos Calvo y Plantón (…) En la muestra tomada en la Naciente Carlos Calvo no encontramos la presencia de residuos de los plaguicidas incluidos en el análisis (…) En la muestra tomada en la Naciente Plantón no encontramos la presencia de residuos de los plaguicidas incluidos en el análisis (…) Si detectamos varios residuos de plaguicidas a un nivel de trazas, por debajo del límite de reporte. Varios de estos residuos de plaguicidas a nivel de trazas habíamos detectados en las muestras tomadas anteriormente.
Seguimos encontrando estos productos de degradación del funguicida clorotalonil, esta vez reportamos en el informe de análisis las concentraciones detectadas en las muestras del 1,3-dicabamil, 2,4,5,6-tetraclorobenceno y el 4-hidroxiclorotalonil. En la muestra tomada en la Naciente Plantón cuantificamos ambas sustancias y en la Naciente Carlos Calvo solo la primera.”. El Laboratorio Nacional de Aguas del ICAA, mediante el memorando n.° PRE-LNA-2022-00193, de 28 de marzo de 2022, señala: “ De acuerdo con su oficio GSD-UEN-GAR-2022-01098, y en atención a la revisión y al criterio que solicita al Laboratorio Nacional de Aguas, una vez revisados los informes respectivos se hacen las siguientes observaciones al respecto: 1- Se observa que los análisis realizados por el IRET no se encuentran bajo el alcance de Acreditación de la Norma Internacional INTE-ISO/IEC 17025:2017. 2- El Reglamento para la Calidad del Agua Potable N° 38924-S solicita en su Artículo 10 que los entes operadores públicos, deben presentar los reportes de análisis emitidos por laboratorios, cuyos métodos de ensayos estén acreditados, conforme lo establece el artículo 34 de la Ley Nº 8279 de 02 de mayo del 2002, “Sistema Nacional para la Calidad” publicada en el Diario Oficial La Gaceta Nº 96 de 21 de mayo del 2002. 3- Que los analitos que superan el Valor Máximo admitido establecido para plaguicidas en el Reglamento para la Calidad del Agua Potable N° 38924-S fueron el 1,3-dicarbamoil-2,4,5,6-tetraclorobenceno y el 4-hidroxicloratonil, los cuales son metabolitos del plaguicida Clorotalonil. 4- Que el IRET en el oficio UNA-LAREP-OFI-060-2021 S20-13-05-2021 declara que “Todavía nos falta hacer algunos ensayos para optimizar la determinación de estos compuestos en muestras de aguas y suelos.”, por lo cual el Laboratorio Nacional de Aguas entiende que todavía es necesario realizar más pruebas de laboratorio para que el método con que se determinaron estos metabolitos se encuentre debidamente validado.
De acuerdo con todo lo anterior se concluye que aún no es posible tomar estos análisis como concluyentes en lo relacionado con el Reglamento para la Calidad del Agua Potable N° 38924-S, sin que esto sea impedimento para que la ORAC tome las medidas preventivas/correctivas que considere pertinentes.”. No obstante, el gerente general del ICAA informa: “la Institución continúa realizando las investigaciones para realizar colaboración con algún laboratorio a nivel nacional o internacional para poder determinar con base científica, y en cumplimiento de los Reglamentos aplicables a la materia, la presencia de metabolitos de Clorotalonil.”. El 1° de abril de 2022, el recurrente [Nombre 002] interpuso una denuncia ante el ICAA por la situación acusada en este proceso. Las autoridades del ICAA no se reportaron por la institución directamente debido a que el Laboratorio Nacional de Aguas realizó los análisis de los plaguicidas que tiene acreditados, entre los que se incluye el Clorotalonil.
Explican que los metabolitos aludidos, no forman parte del alcance acreditado por el laboratorio. Por ello, sostiene que no puede declararse la existencia de contaminación, sino que los resultados de la IRET (UNA) solo pueden ser tomados como alerta, pero no como datos concluyentes. El ICAA ha llevado a cabo gestiones para la adquisición de los insumos necesarios para ampliar el alcance analítico y que se abarquen en los estudios los metabolitos alegados en el asunto de marras; no obstante, se deben efectuar las respectivas contrataciones administrativas. Por medio del memorando GSD-UEN-GAR-2022-02876 de 21 de julio de 2022, la UEN Gestión de Acueductos Rurales consignó: “En relación con las áreas de Protección, actualmente la ASADA se encuentra en el proceso de realización de estudios hidrogeológicos integrales y estudios hidrogeológicos de áreas de protección, los cuales brindarán datos valiosos para ejercer un control efectivo de estas áreas.
Se cuenta con órdenes sanitarias emitidas por el Ministerio de Salud a las personas agricultoras que se encontraban dentro del área de protección (…) actualmente se están realizando esfuerzos por subsanar y aprobar los estudios hidrogeológicos de las nacientes en cuestión, se cuenta con ordenes sanitarias emitidas a las personas propietarias que sembraban dentro del área de protección y el acueducto se encuentra dentro del Programa Sello de Calidad Sanitaria del Laboratorio Nacional De Aguas, lo que garantiza que se están realizando los análisis para determinar la potabilidad del agua, así como la evaluación de los factores de riesgo relativos al estado de las áreas de protección. En este sentido, desde la Oficina Regional Central Este en coordinación con la ASADA se estarán realizando visitas periódicas para la verificación de las áreas de protección y ante la detección de alteraciones se estará comunicando al Ministerio de Salud para que tome las medidas correspondientes .
No es correcto afirmar que no se han realizado acciones para proteger el agua, adicionalmente a los procesos que se describen en el HECHO OCTAVO, desde la Subgerencia de Gestión de Sistemas Delegados, para abordar la problemática presentada y tomar acciones puntuales de mitigación se formuló un Plan de Seguridad del Agua (anexo 2) El objetivo del Plan de Acción es plantear e implementar un Sistema Integral Gestión del Riesgo para la ASADA de Cipreses de Oreamuno y de esta manera identificar y evaluar los riesgos en todo el proceso de la prestación de servicio, con lo cual se podrán definir las acciones para mitigarlos. Para este fin la Subgerencia de Gestión de Sistemas Delegados, colaborará y dará acompañamiento metodológico para el desarrollo e implementación del Plan de Seguridad del Agua (PSA), basada en le metodología institucional.”. Mediante el memorando GSD-UEN-GAR-2022-02876 de 21 de julio de 2022, la UEN Gestión de Acueductos Rurales indicó: “ No puede comprobarse que la población de Cipreses de Oreamuno consume agua contaminada, debido que técnicamente no se ha podido determinar si el agua en las nacientes Plantón y Carlos Calvo está siendo afectada por residuos de plaguicidas, ni se ha podido cuantificar mediante laboratorio que cuente con el método de análisis acreditado los metabolitos de Clorotalonil, de acuerdo con el criterio del Laboratorio Nacional De Aguas.
Por lo que se deben realizar análisis adicionales para poder aplicar el protocolo de contaminación que daría respaldo a la toma de acciones como una posible clausura de la fuente para el consumo humano y la distribución de agua mediante camiones cisterna, de acuerdo con los procedimientos Institucionales (…) actualmente se encuentran en revisión por parte de la UEN Gestión Ambiental del AyA, los estudios hidrogeológicos para las nacientes Plantón, Carlos Calvo y Edwin Coto (en desuso). Se está realizando un seguimiento especial para poder subsanar por parte de los consultores contratados por la ASADA los informes entregados al AyA debido a que a la fecha estos insumos técnicos no cumplen lo requerido por esta dependencia Institucional. Adicionalmente la ASADA ha solicitado se realice por parte de la UEN Gestión Ambiental del AyA, un estudio hidrogeológico para la delimitación del área de protección especial de las nacientes Carlos Calvo y Plantón (anexo 3), ante lo cual se está reuniendo por parte del ente operador los requisitos, incluyendo la autorización de las personas propietarias para el ingreso de los hidrogeólogos del AyA para realizar los análisis correspondientes.
El Ministerio de Salud ha girado órdenes sanitarias a las personas propietarias que realizaban labores de agricultura en cercanía de la naciente Plantón (anexo 4), por lo que ya existen medidas de restricción ejecutadas por otras Instituciones del Estado en apoyo a la gestión del caso de potencial contaminación. Una vez se cuente con los estudios subsanados y aprobados por la UEN Gestión Ambiental, al haberse determinado el comportamiento hidrogeológico de las nacientes, la zona de recarga y zona de protección, se podrán tomar medidas específicas para realizar una gestión integral de protección del recurso hídrico y las áreas de cobertura boscosa requeridas para que se mantenga su cantidad y calidad (…)”. Por medio del memorando GSD-UEN-GAR-2022-04189 de la UEN Gestión de Acueductos Rurales del ICAA, se consignó: “ En el caso de la Municipalidad de Oreamuno, el gobierno local indica que actualmente mantiene un déficit hídrico de más de 60 L/s en el sistema de acueducto que administra, por lo que no puede aportar en las condiciones actuales ningún caudal.
Adicionalmente el proyecto de aprovechamiento que está siendo ejecutado por esta Municipalidad no ha concluido y no cuenta con sistema de potabilización, o una presión adecuada que pueda permitir en las condiciones actuales (diseño) una interconexión que cubra las necesidades de las comunidades abastecidas por la ASADA Cipreses de Oreamuno. La Municipalidad de Alvarado ha ofrecido colaboración durante reuniones comunales organizadas por este ente operador, pero se desconoce la ubicación de las tuberías de conducción y distribución en relación con el sistema de acueducto delegado a la ASADA Cipreses de Oreamuno. En el caso de la ASADA Santa Rosa de Oreamuno, el 15 de febrero de 2021 se rindió informe según acuerdo de Junta Directiva del AyA N°2007-350 “Procedimiento para asumir sistemas de acueductos y alcantarillados por AyA” mediante oficio GSD-UENGAR-2021-00641 (Anexo). En este informe se detalla la información sobre la factibilidad técnica de la operación de este ente operador del área de cobertura actualmente asignado a la ASADA Cipreses de Oreamuno, sin embargo, no se valoró una clausura total de las nacientes Plantón y Carlos Calvo debido a que se carecía de los datos específicos sobre contaminación con metabolitos de Clorotalonil.
En un análisis reciente se identifica que es necesario incrementar la capacidad hidráulica de la tubería del sector 3 y realizar mejoras importantes en una interconexión entre ambos sistemas (Cipreses y Santa Rosa) construida en 1914. De acuerdo con información suministrada por el equipo de ingeniería de la ORAC los trabajos de mejoras para poder tener una interconexión con suficiente capacidad hidráulica tomarían unos 3 meses. El día 18 de octubre se realizó en colaboración con el Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional (IRET-UNA) un muestreo de las nacientes de dos sistemas de la ASADA Santa Rosa de Oreamuno, para valorar la calidad de agua en relación con la presencia de metabolitos del fungicida Clorotalonil. Este muestreo se deriva de los acuerdos tomados en la reunión sostenida en el Laboratorio Nacional de Aguas el día 17 de octubre, ante la confirmación por parte esta instancia Institucional de la contaminación con estos compuestos sobre el nivel establecido por la norma.
En el caso de la ASADA San Pablo, no se cuentan con suficientes datos. Es necesario valorar el balance hídrico y la capacidad hidráulica debido a que este ente operador carece de Estudio Técnico, el cual debe ser actualizado de manera integral de acuerdo con el Reglamento de ASADAS. Se tiene planificado realizar un muestreo completo de las fuentes para descartar la presencia de Clorotalonil y sus metabolitos, así como una revisión completa del perfil de calidad. Por su parte la ASADA Cipreses de Oreamuno debe realizar varias obras importantes para mejorar su capacidad hidráulica, como se deriva de estudio realizado por parte de Centro de investigación en Vivienda Y Construcción del Instituto Tecnológico de Costa Rica, para lo cual se les ha pedido priorización, costos y tiempo estimado de ejecución. Es posible que el presupuesto disponible por parte de la ASADA Cipreses de Oreamuno no sea suficiente para cubrir las obras necesarias a mediano plazo.
A la fecha no existe factibilidad técnica para la interconexión inmediata en ninguno de los sistemas de abastecimiento circundantes, administrados por ASADAS o alguna Municipalidad. Se recomienda una actualización del informe Según acuerdo de Junta Directiva del AyA N°2007-350 “Procedimiento para asumir sistemas de acueductos y alcantarillados por AyA” mediante el cual debe realizarse un análisis profundo de gestión e infraestructura, valorando la clausura de las fuentes asignadas a Cipreses de Oreamuno y las implicaciones en el balance hídrico y la capacidad hidráulica de ambos sistemas.”. A través del memorando GSD-UEN-GAR-2022-04290 de 25 de octubre de 2022, de la UEN Gestión Acueductos Rurales, se consignó: “Los muestreos realizados los días 18 y 19 de octubre, por personal de la Oficina Regional Central Este del AyA en coordinación con el Laboratorio de IRET en la Universidad Nacional, fueron enfocados a la ASADA Santa Rosa De Oreamuno, abarcando sus 3 sistemas y 7 nacientes.
Los análisis están siendo realizados en el laboratorio de IRET y los resultados se conozcan esta semana, si se mantienen las condiciones operativas normales del equipo. El objetivo de estos muestreos es tener una línea base de calidad en relación con la presencia de metabolitos del fungicida Clorotalonil, de cara a una posible interconexión de los sistemas en el contexto de la clausura de las fuentes aprovechadas por la ASADA Cipreses de Oreamuno. En el caso de las nacientes Plantón y Carlos Calvo, estos muestreos fueron realizados con anterioridad por parte del Laboratorio Nacional de Aguas, el día 26 de septiembre de 2022, cuyo informe de resultados emitidos bajo el código AYA-FPT-011B (anexo) firmados por el jefe del Laboratorio de Química Luis Zúñiga Zúñiga y aprobados por el Dr. Darner Mora Alvarado, director de esta dependencia institucional. Los resultados son los siguientes:

Los resultados obtenidos confirman que los niveles de metabolitos se encuentran sobre el parámetro establecido por el Reglamento para la Calidad del Agua Potable para plaguicidas, el cual es de 0.1 μg/L.

(c) 0,5 En la reunión del día 17 de octubre sostenida en el Laboratorio Nacional de Aguas en Tres Ríos, estuvieron presentes personas representantes del Ministerio de Salud (regional y central), de la Universidad Nacional – IRET, y por parte del AyA: Laboratorio Nacional de Aguas, Oficina Regional Central Este y Subgerencia De Gestión de Sistemas Delegados. En dicha reunión se toman los siguientes acuerdos, los cuales se transcriben textualmente de bitácora anexa, remitida vía correo electrónico por el Ministerio de Salud: 1. Procesamiento de muestras que se recolectaran en ASADA de Santa Rosa 2. Coordinar entrega de materiales para muestreo 3. Acompañamiento y seguimiento de muestreo en la ASADA de Santa Rosa 4. Entrega de informes de resultados LNA - IRET 5. Coordinaciones internas ante una posible intervención del sistema de abastecimiento de agua Se va a continuar con muestreos en las ASADAS de la zona norte de Cartago para determinar la presencia de metabolitos de Clorotalonil, de manera que se pueda realizar una valoración integral de las potenciales fuentes alternativas.”.
En el informe de 19 de octubre de 2022, suscrito por el Dr. Darner Mora Alvarado, funcionario del ICAA, se indicó: “ASUNTO: Resultados de análisis de las muestras de Cipreses y pruebas para desarrollo de método de determinación de metabolitos de Clorotalonil. Debido a las alertas presentadas por el Instituto Regional de Estudios en Sustancias Tóxicas de la Universidad Nacional (IRET) acerca del presunto hallazgo de metabolitos del plaguicida Clorotalonil en la naciente Plantón y en la naciente Carlos Calvo, fuentes de suministro de agua potable de la ASADA Cipreses de Oreamuno, y las solicitudes realizadas por el Ministerio de Salud; se acuerda la realización de un Proyecto conjunto para el Desarrollo de metodologías para la determinación de plaguicidas y sus metabolitos en agua, de interés entre el Laboratorio Nacional de Aguas del Instituto Costarricense de Acueductos y Alcantarillados y el IRET; todo esto bajo observación del Ministerio de Salud.
Para llevar a cabo dicho proyecto se discutió aspectos técnicos en reunión con el Sr. Clemens Ruepert, funcionario del IRET, quien mencionó la posibilidad de llevar a cabo la determinación del metabolito 1,3-dicarbamoyl-2,4,5,6-tetraclorobenceno por la técnica de cromatografía de gases (GC-MS) en el Laboratorio Nacional de Agua (LNA), a pesar de que finalmente ellos obtuvieron mejores resultados por la técnica de HPLC-MS. Con respecto al metabolito 4-hidroxiclorotalonil, por experiencia adquirida del IRET se determinó que la técnica de cromatografía de gases no es la apropiada siendo la cromatografía líquida ( HPLC-MS), la idónea. Como parte de las acciones de colaboración en conjunto, el IRET ofreció y suministró al LNA de un patrón de 1,3-dicarbamoyl-2,4,5,6-tetraclorobenceno, además de los cartuchos de extracción usados por este laboratorio en las determinaciones de dicho metabolito, de modo que el LNA pudiera hacer las pruebas correspondientes y determinar si por la técnica GC-MS es posible detectar dicho metabolito.
El LNA realizó las siguientes tareas usando el patrón de metabolito aportado por el IRET: 1. Se llevó a cabo un estudio de barrido (usando una concentración alta, ppm) para determinar si el equipo logra detectar el compuesto y determinar el tiempo de retención de este. Este estudio obtuvo buenos resultados por cuanto fue posible detectar el metabolito. 2. De acuerdo con la experticia de los técnicos del LNA, se diseñó un método nuevo, con las condiciones cromatográficas de temperatura, tiempo y gradiente. Este estudio requirió de varios ajustes, hasta obtener un método con mejor forma de pico cromatográfico. 3. Se realizó un estudio tipo Auto SRM, para determinar las transiciones másicas y las energías de ionización que generaran los mejor resultados en cuanto a intensidad del pico cromatográfico. 4. Se realizó una gran cantidad de pruebas, variando condiciones del equipo, concentraciones de metabolito y disolventes, revisando en cada caso, las variaciones en el tiempo de retención y las condiciones espectrométricas del análisis. 5.
Para llevar a cabo una optimización adicional, se realizó una reunión virtual, el día 9 de setiembre de 2022, con el Sr. Clemens Ruepert lo anterior con la finalidad de una posible cooperación entre las instituciones y para exponerle los datos metodológicos y resultados, y obtener retroalimentación y recomendaciones. 6. Se aplicaron las recomendaciones referentes a las rampas de calentamiento, según lo indicado por el Sr. Ruepert y se procedió a realizar nuevas pruebas con distintas concentraciones de patrón. Por otro lado, el LNA llevó a cabo, la toma de muestras en la naciente Plantón y la naciente Carlos Calvo, el día 23/8/2022 (AyA-OT-2203554), con el fin de realizar pruebas en el desarrollo de la metodología del análisis del metabolito 1,3-dicarbamoyl-2,4,5,6-tetraclorobenceno, encontrando sospechas de la presencia del metabolito, pero requiriendo aun un mayor desarrollo del método.
De acuerdo con el estudio realizado con el patrón suministrado, se obtuvo que la técnica de GC-MS, si bien permite la detección del metabolito 1,3-dicarbamoyl-2,4,5,6-tetraclorobenceno, posee limitaciones en cuanto a la sensibilidad, ya que la concentración mínima que puede cuantificarse del patrón fue 250 μg/L. Esto implica que, aplicando el pre-tratamiento de muestra actual, el límite de cuantificación del método sería como mínimo 0,63 μg/L, siendo necesario por reglamentación del país obtener valores de 0,1 μg/L o menos. Adicionalmente con la finalidad de optimizar el método, se acordó realizar una nueva toma de muestras en conjunto con el IRET en la comunidad de Cipreses para poder realizar un proceso de pruebas con muestras recientes. Dicho muestreo se llevó a cabo el día 26/9/2022, AYA-OT-2203999 y en el mismo, se tomaron muestras para ser procesadas en el LNA y muestras para ser procesadas en el IRET.
Muestras tomadas el 26/09/2022. Con las limitaciones de sensibilidad del método en desarrollado, se procedió a realizar la inyección de las muestras recolectadas en las dos nacientes de la comunidad de Cipreses (Plantón y Carlos Calvo), así como cinco patrones de 250 μg/L 500 μg/L, 750 μg/L, 1000 μg/L y 2000 μg/L. A continuación, se detallan los resultados obtenidos: Para la naciente Plantón se obtuvo una concentración aproximada de 1,3- dicarbamoyl-2,4,5,6-tetraclorobenceno de 19,36 μg/L en la muestra recolectada, mientras que, para la naciente Carlos Calvo, la concentración aproximada fue de 1,73 μg/L en la muestra recolectada. Para las determinaciones en ambos muestreos se utilizó el patrón facilitado por el Sr. Clemens Ruepert. Cabe destacar que el patrón usado no es certificado con trazabilidad bajo los términos de Acreditación en la norma internacional INTE-ISO/IEC 17025:2017, (ni se ha encontrado un patrón que cumpla con esto).
Adicionalmente, el método utilizado para esta determinación no se encuentra acreditado, y de momento aún no se posee la validación correspondiente, generando poca certeza en la concentración exacta del compuesto. Sin embargo, las concentraciones encontradas son superiores al valor máximo admisible del reglamento DE 38924-S. Con estos resultados, se vuelve necesario e imperante fortalecer al Laboratorio Nacional de Aguas con el fin de dotarlo de espacio físico, equipos e insumos para introducir nuevos análisis como es el caso de los metabolitos supracitados a fin de mantener una vigilancia y control adecuado; además es recomendable la integración de una comisión interinstitucional que lleve a cabo un análisis de los resultados expuestos en este informe, tome acciones inmediatas de los mismos y prepare acciones correctivas, preventivas y de minimización de riesgos en la población de Cipreses de Oreamuno.”.
Por medio de la orden sanitaria n.° CE-ARS-O-OS-4986-2020 de 17 de diciembre de 2021, la autoridad recurrida le ordenó al presidente de la ASADA de Cipreses lo siguiente: “realizar análisis semestrales del Nivel Cuarto (N4) en la Naciente Plantón de control, indiferentemente a los análisis que por reglamento deben presentar semestralmente, para el control de dichos parámetros en la fuente, siendo estos revisados en el reporte semestral de la calidad del agua potable que deben ser presentados por la ASADA de Cipreses (…)”. El resultado de los análisis fue recibido por el Área Rectora de Salud el 21 de diciembre de 2021, y en el informe técnico MS-DRRSCE-DARSO-IT-00028-2022 de 2 de febrero de 2022, se consignó: “Luego de la revisión de los resultados de laboratorio, se detectan plaguicidas a un nivel de trazas y la presencia de productos de degradación del funguicida clorotalonil superando los límites de los valores máximos admisibles (…) Es importante contar con el apoyo del Nivel Central, específicamente con el Dr. Albin Badilla Mora de Vigilancia y Control de Agua Potable, para que se nos aclare sobre la problemática y el paso a seguir en cuanto a estos productos de degradación del funguicida clorotalonil detectados en el acueducto de la ASADA de Cipreses.”.
(Informe de la autoridad recurrida y prueba documental). Por medio del oficio MS-DRRSCE-DARSO-00181-2022 de 7 de marzo de 2022, el Área Rectora de Salud accionada le solicitó a la ASADA de Cipreses incluir dentro de los próximos muestreos por plaguicidas, análisis a nivel de la red de distribución, a fin de contar con la información exacta de la totalidad del sistema; asimismo, “presentar en un plazo de 10 días hábiles las acciones definitivas que tomará su representada a corto plazo para garantizar agua de calidad apta para el consumo humano a la población abastecida (…)”. El 21 de marzo de 2022, la autoridad accionada realizó una reunión virtual con el Dr. Albin Badilla Mora, experto en agua potable del Ministerio de Salud. En tal reunión se acordó realizar un muestreo de las nacientes y la red de distribución del acueducto. El 1° de abril de 2022, el recurrente [Nombre 002] interpuso una denuncia ante el Área Rectora de Salud accionada por los hechos objeto de este recurso.
En el informe técnico MS-DRRSCE-DARSO-IT-00124-2022 de 4 de abril de 2022, se indicó: “RECOMENDACIONES: Girar orden sanitaria al Sr. Virgilio Ulloa Ulloa, presidente de la ASADA de Cipreses, para que procesa de forma inmediata a la delimitación de la zona de protección de la Naciente Plantón y Naciente Carlos Calvo (…) Girar orden sanitaria, a los propietarios de las fincas circundantes faltantes de notificación (…) de abstenerse de realizar acciones que contrapongan la salud de la población bajo principio precautorio y los principios de norma actual; acciones que se cometan dentro del área que establezca la Ley de Aguas N° 276 y que pongan en riesgo el agua de la Naciente Plantón (…) Además, girar orden sanitaria, mediante los términos anteriores; a los propietario de las fincas circundantes (…) de la Naciente Carlos Calvo (…)”. El 6 de abril de 2022 se efectuó un muestreo en las Nacientes Carlos Calvo y Plantón, así como en la red de distribución.
En el informe n.° MS-DPRSA-USA-679-2022 de 28 de abril de 2022 de la Unidad de Salud Ambiental del Ministerio de Salud, se indicó: “RESULTADOS. Según se observa en la Tabla 1 no se detectó el plaguicida clorotalonil en las muestras recolectadas en la ASADA Cipreses, tanto para el Sistema Plantón como para el Sistema Carlos Calvo. Es importante recalcar que este análisis fue realizado en un laboratorio acreditado con el alcance de la norma INTE-ISO/IEC 17025:2017 según lo establece el Reglamento N° 38924-S (…) los valores de nitritos y nitratos se encuentran dentro de los parámetros permitidos por el Reglamento para la Calidad del Agua Potable n° 38924-S sin representar un riesgo para la salud (…) En estos análisis puntuales realizados a ambos sistemas en sus nacientes no se detectó la presencia de plaguicidas, tampoco se detectó clorotalonil”. Por orden sanitaria de 29 de abril de 2022, la autoridad accionada le ordenó a la ASADA Cipreses “mantener involucrado al personal del acueducto en las labores de vigilancia y control de los límites de las nacientes, además continuar con las gestiones necesarias para la obtención de un estudio hidrogeológico de la zona, con el fin de tener evidencia científica para la toma de acciones que conlleven a una protección mayor del recurso hídrico, garantizando el mismo y realizar análisis por plaguicidas (N4) en el mes de Julio del año 2022, que incluyan clorotalonil en las Nacientes Plantón y Carlos Calvo, por un laboratorio cuyos métodos de ensayo estén acreditados, lo anterior en acatamiento al artículo 10 del Decreto N° 38924-S, Reglamento para la Calidad del Agua Potable y sus Reformas y presentarlos en el Área Rectora de Salud de Oreamuno”.
El 4 de mayo de 2022, el funcionario Albin Badilla Mora remitió un correo electrónico al rea Rectora de Salud de Oreamuno, en el que señaló: “La presente es para solicitarle su colaboración para reunirnos por medio de TEAMS con los compañeros del ARS de Oreamuno junto con la Unidad de Salud Ambiental para revisar el caso de la ASADA de Cipreses donde se presentó un alerta de contaminación por productos derivados de Clorotalonil 1,3-dicarbamoil- 2,4,5,6 tetraclorobenceno y 4-hidroxiclorotalonil y conoce un poco la posición del LNA y posibles acciones que podamos tomar en conjunto.”. En la reunión de 6 de mayo de 2022, se expuso la problemática de no contar con un laboratorio en el país que realice las pruebas de los metabolitos, por lo que se acuerda programar una nueva reunión con la participación del Laboratorio de Análisis de Residuos de Plaguicidas (LAREP) y de la Oficina Regional de Acueductos y Alcantarillados Central Este.
En la bitácora de la reunión de 13 de mayo del año en curso, se consignó: “(…) hay una alerta con el Clorotalonil pero se requiere más pruebas de validar el método, validar la matriz y entender un poco y tener certeza de las concentraciones y de las cantidades (…)”. Asimismo, se acordó realizar una nueva reunión virtual con el Ministerio de Salud, Acueductos y Alcantarillados y solicitar el criterio técnico al Laboratorio Nacional de Aguas referente al caso de la ASADA de Cipreses.”. Mediante el oficio MS-DM-5043-2022 de 3 de junio de 2022, suscrito por la ministra de Salud y dirigido al presidente ejecutivo del ICAA, se anotó: “Le solicito de la manera más respetuosa interponga sus buenos oficios para que de manera urgente los análisis de medición en agua potable de las moléculas, 1,3 dicarbamoil-2, 4,5,6-tetraclorobenceno y el 4-hidroxiclorotalonil sean introducidos en el panel de plaguicidas que realiza el Laboratorio Nacional de Aguas y que en el menor tiempo posible puedan ser realizados estos análisis en el agua de la comunidad de Cipreses de Oreamuno y que a través de la Unidad de Salud Ambiental del Ministerio de Salud se prepare un plan de medición de estas moléculas en los acueductos que puedan tener factores de riesgo de contaminación por la amplia extensión agrícola en esta y otras zonas del país.”.
El Área Rectora de Salud de Oreamuno informa que se han iniciado las coordinaciones interinstitucionales para contar con un laboratorio debidamente acreditado, a fin de analizar productos de degradación del clorotalonil, y de esa forma constatar o descartar la presencia de estos metabolitos en el agua de las nacientes de marras.”. En el informe técnico n.° MS-DRRSCE-URS-IT-0310-2022 de 18 de octubre de 2022 de la Unidad Rectoría de la Salud de la Dirección Regional Central Este del Ministerio de Salud, se consignó: “ procedí a solicitar criterio por parte del Dr. Albin Badilla Mora, Doctor en Microbiología destacado en la Unidad de Salud Ambiental, Dirección de Protección Radiológica y Salud Ambiental del Nivel Central del Ministerio de Salud, quien mediante correo electrónico institucional contestó lo siguiente, cito textualmente (…) “El Clorotalonil es un fungicida aprobado para uso en el país registrado bajo una gran variedad de nombres y usado en la agricultura de variedad de productos.
Una vez la sustancia química entra en contacto con el ambiente, aire, suelo y / o microorganismos sufre una serie de modificaciones producto del metabolismo de organismos vivos o procesos químicos que lo descomponen en otras moléculas conocidas como metabolitos o productos de degradación, para el caso del Clorotalonil existe registro de mas (sic) de 7 moléculas distintas de degradación. Para el caso específico de los metabolitos 1,3-dicarbamoil-2,4,5,6 tetraclorobenceno y el 4-hidroxiclorotalonil existe poca documentación disponibilidad, en especial sobre la afectación para la salud humana, existiendo un poco mas (sic) de información sobre riesgos ambientales y ecotóxicos para el 4- hidroxiclorotalonil. Según revisión del caso del químico clorotalonil y su estatus internacional en la Unión Europea se decidió en el 2019 prohibir su uso porque se identificó un problema crítico en relación con la contaminación de las aguas subterráneas por los metabolitos del plaguicida.
La Autoridad Europea no pudo descartar un posible problema de genotoxicidad de los residuos a los que se verían expuestos los consumidores y detectó un alto riesgo para los anfibios y los peces en todos los usos evaluados. Asimismo, el clorotalonil, como tal, está clasificado como carcinógeno. 1 Por otro lado, la Agencia de Protección Ambiental de los Estados Unidos (EPA) ha determinado que los productos del clorotalonil no suponen riesgos para los seres humanos o el medio ambiente mientras que se sigan los usos autorizados y las indicaciones de la etiqueta del producto. Sin embargo, ha declarado que existe un faltante de estudios para determinar riesgos por sus metabolitos. 2 En conclusión, desde el punto de vista de salud humana existe una deficiencia en estudios científicos que caractericen e identifiquen riesgos asociados a la salud por el consumo, ingesta o cualquier otro tipo de contacto de los metabolitos 1,3-dicarbamoil-2,4,5,6 tetraclorobenceno y el 4- hidroxiclorotalonil, sin embargo sí existen estudios que caracterizan al clorotalonil como altamente tóxico para la vida acuática y moderadamente tóxico en aves y lombrices.
Además, se ha tipificado al 4- hidroxiclorotalonil como altamente tóxico en un estudio realizado en roedores. 3 Por lo que se debe de considerar con extrema precaución cualquier indicio de contaminación con este plaguicida o metabolito y tomar las medidas necesarias para evitar su ingesta o contacto en vista de la poca evidencia científica que existe referente a la salud humana y apoyarse en los estudios que confirman la ecotoxicidad que presenta, así como el riesgo para la salud ambiental.”. Por medio del oficio MS-DM-9473-2022 de 20 de octubre de 2022, dirigido al director de la Dirección Regional Rectora de Salud Central Este y al director del Área Rectora de Salud de Oreamuno, la ministra de Salud señaló: “Asunto: Caso urgente de atención en ASADA Cipreses de Oreamuno de Cartago (…) se les indica que de manera urgente coordinen lo necesario para que: · Se emita una Orden Sanitaria para que se ejecute una clausura inmediata de las fuentes de agua para consumo humano que utiliza la ASADA de Cipreses de Oreamuno, en específico las fuentes Plantón y Carlos Calvo.
Ante la ausencia de información que caracterice e identifique riesgos asociados a la salud por el consumo, ingesta o cualquier otro tipo de contacto de los metabolitos el agua estas fuentes no podrá ser utilizada para consumo humano, preparación de alimentos y actividades de higiene corporal como parte de un principio precautorio. Se puede considerar el uso del agua de estas fuentes para el funcionamiento de inodoros y otras actividades de limpieza y desinfección intradomiciliaria. · Se emita una Orden Sanitaria al Instituto Costarricense de Acueductos y Alcantarillados para que se brinden (sic) agua a la comunidad de manera inmediata por medio de camiones cisterna o cualquier otro mecanismo que aseguro (sic) disponibilidad de agua segura para consumo humano en la población de Cipreses. · Se emita una Orden Sanitaria a la ASADA Cipreses y al Instituto Costarricense de Acueductos y Alcantarillados para que se comuniquen a la comunidad de manera correcta y asertiva, así como por la mayor cantidad de canales posibles la situación que presenta la ASADA Cipreses sobre los metabolitos del plaguicida Clorotalonil y la aplicación del principio de precaución con el fin de prevenir problemas de salud en la población.
No se omite manifestar que el Ministerio de Salud debe de cumplir un rol vigilante de este proceso. · Solicitar mediante Orden Sanitaria un Plan de Acción con acciones a corto, mediano y largo plazo al Instituto Costarricense de Acueductos y Alcantarillados en un plazo considerable de ley donde se indique los plazos a seguir para solucionar la situación de contaminación de la ASADA Cipreses, ya sea mediante interconexiones con otras ASADAS, búsqueda de nuevas fuentes, aplicación de sistemas de tratamiento entre otras, según sea determinado por su rectoría técnica en el agua potable. · Se le solicite mediante la DRRS Central Este y el ARS de Oreamuno a la oficina local y/o regional del Ministerio de Agricultura que efectúe acciones inmediatas con el fin de buscar moléculas sustitutas, asegurar las buenas prácticas agrícolas y uso correcto de plaguicidas, en especial de clorotalonil; que las acciones aplicadas estén articuladas con indicadores de desempeño con el fin de poder medir, monitorear y comparar los resultados obtenidos que determinen una mitigación y disminución de la contaminación a fin de obtener un saneamiento de las fuentes de agua; en caso de que el MAG no pueda poner en práctica este plan de acciones de debe proceder con una solitud de prohibición del clorotalonil, debido a su probada capacidad de contaminar fuentes y la poca capacidad de las instituciones para poder medir sus metabolitos.”.
Por medio de la orden sanitaria MS-DRRSCE-DARSO-OS-0087-2022 de 20 de octubre de 2022, el Área Rectora de Salud le ordenó al presidente de la ASADA de Cipreses lo siguiente: “Plazo de cumplimiento de la orden sanitaria: INMEDIATAMENTO (…) Proceder a la clausura inmediata de las fuentes de agua para consumo humano que utiliza la ASADA de Cipreses de Oreamuno, en específico las fuentes Plantón y Carlos Calvo. Ante la ausencia de información que caracterice e identifique riesgos asociados a la salud por el consumo, ingesta o cualquier otro tipo de contacto de los metabolitos el agua de estas fuentes no podrá ser utilizada para consumo humano, preparación de alimentos y actividades higiene corporal como parte de un principio precautorio. Se puede considerar el uso del agua de estas fuentes para el funcionamiento de inodoros y otras actividades de limpieza y desinfección intradomiciliaria. También se le notificó la orden sanitaria MS-DRRSCE-DARSO-OS-0091-2022, en la que se dispuso: “1) Proceder a comunicarle urgentemente a la comunidad de Cipreses de manera correcta y asertiva, así como por la mayor cantidad de canales posibles la situación que presenta la ASADA DE Cipreses, sobre los metabolitos del plaguicida Clorotalonil y la aplicación del principio precautorio, con la finalidad de prevenir problemas de salud en la población, así como el suministro del agua por medio de cisternas.”.
Mediante la orden sanitaria MS-DRRSCE-DARSO-OS-0088-2022 de 20 de octubre de 2022, dirigida al presidente ejecutivo del ICAA, el Área Rectora de Salud de Oreamuno dispuso: “Plazo de cumplimiento de la orden sanitaria: INMEDIATAMENTE (…) 1) Brindar agua a la comunidad de Cipreses de Oreamuno, de manera inmediata, por medio de camiones cisterna o cualquier otro mecanismo, que asegure disponibilidad de agua segura para consumo humano. (…)”. Asimismo, se emitió la orden sanitaria MS-DRRSCE-DARSO-OS-0095-2022, también dirigida a la dependencia aludida, en la que se ordenó: “Plazo de cumplimiento de la orden sanitaria: 10 días naturales (…) 1) Presentar ante el Área Rectora de Salud de Oreamuno, un Plan de Acciones correctivas indicando el responsable de analizar las actividades y el cronograma donde se detallen las fechas de la realización de las actividades, con acciones a corto, mediano y largo plazo, en un plazo considerable de ley donde se indique los pasos a seguir para solucionar la situación de contaminación de la ASADA de Cipreses, ya sea mediante interconexiones con otras ASADAS, búsqueda de nuevas fuentes, aplicación de sistemas de tratamiento entre otras, según sea determinado por su rectoría técnica en el agua potable.”.
Desde este panorama, resulta necesaria la injerencia de esta jurisdicción constitucional.
Al respecto, se verifica que las autoridades recurridas, al menos desde el año anterior, han efectuado esfuerzos para constatar o descartar la presencia de plaguicidas en las Nacientes de Plantón y de Carlos Calvo (sistemas administrados por la ASADA de Cipreses de Oreamuno). En tal sentido, se han llevado a cabo distintos estudios respecto al plaguicida clorotalonil, ante la sospecha de posibles residuos en las nacientes aludidas. Así, en el informe nro. MS-DPRSA-USA-679-2022 de 28 de abril de 2022, la Unidad de Salud Ambiental del Ministerio de Salud consignó: “RESULTADOS. Según se observa en la Tabla 1 no se detectó el plaguicida clorotalonil en las muestras recolectadas en la ASADA Cipreses, tanto para el Sistema Plantón como para el Sistema Carlos Calvo (…) En estos análisis puntuales realizados a ambos sistemas en sus nacientes no se detectó la presencia de plaguicidas, tampoco se detectó clorotalonil ”.
Sin embargo, desde diciembre del año anterior, el Laboratorio de Análisis de Residuos de Plaguicidas de la UNA efectuó un estudio, en el que detectó productos de degradación del clorotalonil, concretamente: “1,3 dicarbamoil-2, 4,5,6-tetraclorobenceno y el 4-hidroxiclorotalonil”.
Luego, durante la tramitación de este proceso de constitucionalidad, concretamente el 26 de septiembre anterior, se efectuó otro muestreo en las nacientes de marras, cuyo informe de resultados señaló: “se procedió a realizar la inyección de las muestras recolectadas en las dos nacientes de la comunidad de Cipreses (Plantón y Carlos Calvo), así como cinco patrones de 250 μg/L 500 μg/L, 750 μg/L, 1000 μg/L y 2000 μg/L. A continuación, se detallan los resultados obtenidos: Para la naciente Plantón se obtuvo una concentración aproximada de 1,3- dicarbamoyl-2,4,5,6-tetraclorobenceno de 19,36 μg/L en la muestra recolectada, mientras que, para la naciente Carlos Calvo, la concentración aproximada fue de 1,73 μg/L en la muestra recolectada. Para las determinaciones en ambos muestreos se utilizó el patrón facilitado por el Sr. Clemens Ruepert. Cabe destacar que el patrón usado no es certificado con trazabilidad bajo los términos de Acreditación en la norma internacional INTE-ISO/IEC 17025:2017, (ni se ha encontrado un patrón que cumpla con esto). Adicionalmente, el método utilizado para esta determinación no se encuentra acreditado, y de momento aún no se posee la validación correspondiente, generando poca certeza en la concentración exacta del compuesto. Sin embargo, las concentraciones encontradas son superiores al valor máximo admisible del reglamento DE 38924-S.”.
De este modo, si bien los recurridos señalan que los estudios y resultados no se encuentran acreditados en los términos del ordinal 10 del Reglamento para la Calidad de Agua Potable, no menos cierto es que la concentración de metabolitos reportada (19,36 μg/L y 1,73 μg/L) es claro indicio de un problema de contaminación, pues los valores sobrepasan de manera importante el máximo que admite la normativa ordinaria (el cual es 0.1 μg/L). Incluso, véase que la orden sanitaria nro. MS-DRRSCE-DARSO-OS-0087-2022 dispuso que tales fuentes de agua no podrían ser utilizadas para consumo, preparación de alimentos ni actividades de higiene corporal.
Ahora, si bien desde el primer estudio efectuado a finales del año anterior los recurridos conocían sobre la presencia de los metabolitos en las nacientes referidas, no fue sino hasta en el segundo muestreo (efectuado durante el trámite de este recurso) que se tomaron medidas en concreto, sin que de ello se verifique una solución definitiva para la situación de marras.
En tal sentido, si bien mediante las órdenes sanitarias emitidas el 20 de octubre del año en curso se dispuso la clausura inmediata de las fuentes de Plantón y Carlos Calvo de la ASADA de Cipreses, la comunicación a la comunidad de Cipreses de Oreamuno de la situación, el suministro de agua a esta comunidad a través de camiones cisterna y la elaboración de un plan correctivo, no menos cierto es que tales acciones constituyen medidas provisionales, mientras que la situación objeto del sub iudice amerita una solución integral y definitiva dentro de un plazo razonable.
Desde este panorama, en consideración a que desde diciembre del año anterior fueron alertados los recurridos acerca de un problema de contaminación en las nacientes de marras, a que tal situación fue denunciada formalmente por la parte accionante desde abril del año en curso, a que en el último muestreo realizado se detectaron concentraciones de metabolitos que sobrepasan el valor máximo admitido por la normativa ordinaria, y a que el Estado está obligado a la implementación de las medidas necesarias para la tutela efectiva del ambiente y la salud de las personas, este Tribunal declara con lugar el recurso, a fin de que en el plazo máximo de tres meses, contado a partir de la notificación de esta sentencia, los recurridos ejecuten las coordinaciones y acciones pertinentes, en el marco de un plan conjunto, para solucionar de manera integral y definitiva la situación de contaminación por metabolitos de clorotalonil en las nacientes de Plantón y Carlos Calvo de la ASADA de Cipreses de Oreamuno. Asimismo, en el plazo referido, deberán investigar si el problema de contaminación en las nacientes supracitadas ha afectado a otras comunidades. En el ínterin, las autoridades deberán garantizar el suministro de agua potable a las comunidades afectadas mediante camiones cisterna u otra alternativa.
Posibles deficiencias en las políticas preventivas y de control en la potabilidad de las aguas.
La situación planteada por los recurrentes en el presente amparo, es una llamada de atención a las autoridades encargadas del servicio del agua potable, la salud y el medio ambiente. Existe una grave deficiencia en la capacidad que tienen los laboratorios competentes para detectar ciertas sustancias libradas en el ambiente y que se comercializan para uso agrícola o industrial. La lectura de los hechos y pronunciamientos sobre un tema tan delicado como la contaminación de las aguas para consumo humano, suscita variados interrogantes, sin respuesta. Esta incertidumbre es grave si se trata de la salud y el ambiente. Es en el contexto de un proceso sumario de amparo, que se detectan graves limitaciones en la intervención de las autoridades competentes en resguardo del ambiente y la salud humana. Tantas preguntas sin responder en esta indagación sumaria, reconociendo, claramente, que no se tienen los recursos materiales e institucionales para detectar la presencia de sustancias tóxicas en el agua de consumo humano. Lo reconoce la propia institución que debe cumplir con esta misión. Destaco de la decisión que suscribo, los siguientes hechos:
1-El 4 de mayo de 2022, el funcionario Albin Badilla Mora remitió un correo electrónico al rea Rectora de Salud de Oreamuno, en el que señaló: “La presente es para solicitarle su colaboración para reunirnos por medio de TEAMS con los compañeros del ARS de Oreamuno junto con la Unidad de Salud Ambiental para revisar el caso de la ASADA de Cipreses donde se presentó un alerta de contaminación por productos derivados de Clorotalonil 1,3-dicarbamoil- 2,4,5,6 tetraclorobenceno y 4-hidroxiclorotalonil y conoce un poco la posición del LNA y posibles acciones que podamos tomar en conjunto.”. (Informe de la autoridad recurrida y prueba documental).
2-En la reunión de 6 de mayo de 2022, se expuso la problemática de no contar con un laboratorio en el país que realice las pruebas de los metabolitos, por lo que se acuerda programar una nueva reunión con la participación del Laboratorio de Análisis de Residuos de Plaguicidas (LAREP) y de la Oficina Regional de Acueductos y Alcantarillados Central Este. (Informe de la autoridad recurrida).
3-En la bitácora de la reunión de 13 de mayo del año en curso, se consignó: “(…) hay una alerta con el Clorotalonil pero se requiere más pruebas de validar el método, validar la matriz y entender un poco y tener certeza de las concentraciones y de las cantidades (…)”. Asimismo, se acordó realizar una nueva reunión virtual con el Ministerio de Salud, Acueductos y Alcantarillados y solicitar el criterio técnico al Laboratorio Nacional de Aguas referente al caso de la ASADA de Cipreses.”. (Informe de la autoridad recurrida y prueba documental).
4-Mediante el oficio MS-DM-5043-2022 de 3 de junio de 2022, suscrito por la ministra de Salud y dirigido al presidente ejecutivo del ICAA, se anotó: “Le solicito de la manera más respetuosa interponga sus buenos oficios para que de manera urgente los análisis de medición en agua potable de las moléculas, 1,3 dicarbamoil-2, 4,5,6-tetraclorobenceno y el 4-hidroxiclorotalonil sean introducidos en el panel de plaguicidas que realiza el Laboratorio Nacional de Aguas y que en el menor tiempo posible puedan ser realizados estos análisis en el agua de la comunidad de Cipreses de Oreamuno y que a través de la Unidad de Salud Ambiental del Ministerio de Salud se prepare un plan de medición de estas moléculas en los acueductos que puedan tener factores de riesgo de contaminación por la amplia extensión agrícola en esta y otras zonas del país.”. (Prueba documental).
La alerta sobre sustancias tóxicas no es reciente, han pasado varios meses en medio de la inacción y los interrogantes, comprobando limitaciones insalvables que reconocen las instituciones locales y nacionales. Este caso puede ser una muestra representativa de lo que ocurre en otras comunidades y territorios del país, situaciones en que las autoridades no pueden asumir sus competencias genuinas; deben los ciudadanos recurrir a esta instancia para hacer preguntas que no se visibilizan a causa de la limitación de recursos y la inercia burocrática. El país no cuenta con un laboratorio que realice las pruebas de los metabolitos, qué conclusión más inquietante, reconocida por los recurridos; los informes de la Universidad Nacional, son, según las autoridades competentes, una alerta, sólo eso. Poco se dice si se califica como una alerta, creo que es más que una alerta, es un reconocimiento inquietante sobre la imposibilidad de dar una respuesta satisfactoria a las personas que han planteado el amparo.
Se aprecia en este caso la imposibilidad que tiene la autoridad de salud y del servicio de agua potable, de realizar acciones preventivas eficaces en resguardo de la salud de los ciudadanos. Leyendo los informes de los entes recurridos, me pregunto sobre el peligro para el ambiente y la salud humana que representa el uso de una sustancia como el Cloratalonil. Este interrogante es uno de los puntos inquietantes en medio de tantas incertidumbres y omisiones. Tanto que nos falta por hacer en materias tan delicadas y sensibles para la ciudadanía, como el agua potable y la tutela de un ambiente sano y ecológicamente equilibrado. Las limitaciones fiscales y sus reglas no deben debilitar materias tan relevantes, tan trascendentales. Este caso, es una muestra de eso: la postergación de la salud y del ambiente.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa que las autoridades recurridas, han omitido cumplir con su deber de proteger la salud y el ambiente, pues aún no han puesto fin al supuesto problema de contaminación de aguas provocado por el uso del de un plaguicida, lo que amenaza lesionar el derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso que se ejecuten las coordinaciones y acciones pertinentes, a fin culminar todos los estudios técnicos necesarios para obtener resultados que acrediten o descarten, con razonable grado de certeza, la contaminación por plaguicidas en las nacientes de Plantón y Carlos Calvo de la ASADA de Cipreses de Oreamuno. Así como que, si se determinare con razonable grado de certeza la contaminación en las nacientes citadas, deberán ejecutar las coordinaciones y acciones pertinentes, en el marco de un plan conjunto, para solucionar de manera integral y definitiva la situación.
En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N°27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N°43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Eric Alonso Bogantes Cabezas y María José Lafuente González, por su orden, gerente general del Instituto Costarricense de Acueductos y Alcantarillados y directora a.i. del Área Rectora de Salud de Oreamuno, o a quienes respectivamente ocupen tales cargos, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus respectivas competencias para que, en el plazo máximo de TRES MESES , contado a partir de la notificación de esta sentencia, se ejecuten las coordinaciones y acciones pertinentes, en el marco de un plan conjunto, para 1) solucionar de manera integral y definitiva la situación de contaminación por metabolitos de clorotalonil en las nacientes de Plantón y Carlos Calvo de la ASADA de Cipreses de Oreamuno; y 2) investigar si el problema de contaminación en las nacientes supracitadas ha perjudicado a otras comunidades de la zona.
En el ínterin, las autoridades supracitadas deberán garantizar el suministro de agua potable a las comunidades afectadas mediante camiones cisterna u otra alternativa. Lo anterior se dicta con la advertencia de que, según lo establecido por el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Cruz Castro consgina ntoa. El magistrado Salazar Alvarado pone nota.
La Magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese esta sentencia a la defensora de los Habitantes para lo de su cargo. Notifíquese.
