Document Review Decision No. 2022025176 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty a.m. on October twenty-fifth, two thousand twenty-two.

Amparo proceeding (recurso de amparo) processed under expediente number 22-009841-0007-CO, filed by Nombre01, identity card CED01, against the MUNICIPALIDAD DE CAÑAS, the MINISTERIO DE SALUD, and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Findings of Fact 1. In a filing received by the Office of the Clerk of the Chamber on May 09, 2022, the petitioner brought an amparo proceeding against the Municipalidad de Cañas and stated that: he is an older adult and a resident of Dirección01. He notes that part of a body of water identified as Poza de Agua flows through that community. He explains that, due to the widening of Ruta Interamericana Uno, the aforementioned pool underwent changes to its natural channel, specifically in the western sector. He notes that this occurred because the Municipalidad de Cañas allowed stormwater (aguas pluviales), wastewater (aguas residuales), and sewage (aguas negras) from the homes to be discharged into that body of water. He complains that the situation described has arisen from the negligence of the employees of the respondent municipality, who failed to exercise proper oversight and enforce the regulations governing the urban-planning requirements that buildings generally must meet.

He asserts that this omission resulted not only in the discharge of stormwater and wastewater, but also sewage into the collection pipes that empty into the aforementioned pool. He further alleges that the municipal government, using municipal machinery, carried out work to widen the stream channel, causing wastewater to accumulate extensively. He maintains that the environment has become unsanitary and foul-smelling as a result of the sewage discharge, creating an ideal habitat for mosquitoes and all kinds of insects, a situation affecting both Dirección02 and La Unión. He reiterates that the situation currently endured by their communities is unfair, untenable, and serious because they must withstand the stench and the danger to their health. He argues that the problem described compels them to seek protection of their right to health because of the negligence of the municipal entity, which has permitted housing development without exercising the oversight and supervision incumbent upon it or taking action to resolve the aforementioned problem.

He further states that the Ministerio de Salud is aware of the situation described but has taken no action to remedy it. He adds that they must constantly apply insecticides in their homes, with the high financial cost and harmful effects this entails. For the reasons stated, he requests that this Chamber grant the petition with the consequences prescribed by law.

2. Nombre02, in her capacity as Ministra de Salud, reports under oath and attaches official letter N° MS-DRRSCH-161-2022, signed by the Área de Salud de Cañas, which states verbatim as follows:

“FIRST—Regarding the reported facts, the administrative file contains a record of the handling of Complaint 59-2021, filed May 12, 2021, by the residents of Dirección02 against La Municipalidad de Cañas, stating: ‘…on September 23, 2020, a complaint was filed with the local government concerning the situation experienced by residents regarding the dry creek bed running from Dirección02 to Dirección03; 100m South of Super San Andrés, water stagnates in the channel of that stream, producing foul odors, rodents, and mosquitoes. It is filled with garbage and other waste, and the water is no longer clear but black and foul-smelling. These conditions are harmful to our community and may transmit diseases.’ Accordingly, the complainants were provided a response through Official Letter MS-DRRSCH-DARSCÑ-316-2021, dated July 21, 2021, stating: ‘The matter will be referred to Municipalidad de Cañas for the appropriate cleaning.

Because this is a widespread wastewater problem in your neighborhood, the matter will be addressed by the Comisión de Aguas Residuales de Cañas in order to seek a collective solution to the problem….’ The file also contains the forwarding email copied to the Alcalde Municipal and the Comisión de Aguas Residuales (Pages n° 00001, 00002, 00003, expediente Barrio San Martín, aguas residuales). SECOND—Likewise, I must state that on August 05, 2021, the Dirección General de Salud forwarded the same complaint under Official Letter MS-DGS-3379-2021, sequentially numbered Complaint 98-2021. Consequently, the matter was resolved through Technical Inspection Report MSDRRSCH-DARSCÑ-IT-0414-2021, dated August 16, 2021, and by service of Health Order (Orden Sanitaria) MS-DRRSCH-DARSCÑ-317-2021 on August 17, 2021. Through Official Letter MS-DRRSCHDARSCÑ-343-2021, dated August 19, 2021, a response was provided to Official Letter MS-DGS-3379-2021, and the matter was referred to the Comisión de Aguas Residuales, together with Official Letter MS-DRRSCH-DARSCÑ-063-2022 responding to Complaint 098-2021.

(Pages n° 00004, 00005, 00007, 00008, 00009, 00013, expediente Barrio San Martín, aguas residuales). THIRD—On September 07, 2021, Official Letter OFC-ALC-349-2021 was received, issued by the Alcalde Municipal to the residents of Barrio San Martín, reporting on the actions taken and scheduled by the Municipalidad to resolve the problem of water flowing through the ditch at the former airfield, actions related to the Health Order. (Pages n° 00011, 00012 expediente Barrio San Martín, aguas residuales). FOURTH—The file of the Comisión de Aguas Residuales de Cañas contains the Meeting Log dated October 14, 2021, in which the Municipalidad de Cañas states that the ditch in Barrio San Martín will be cleaned and a follow-up analysis will be conducted. It should be noted that the Comisión de Aguas Residuales de Cañas comprises the Municipalidad, AyA, and Ministerio de Salud for the purpose of addressing and coordinating, on an interinstitutional basis, problems involving wastewater management in the canton.

(Pages n° 00153, 00154 expediente Comisión de Aguas Residuales de Cañas). FIFTH—The file of the Comisión de Aguas Residuales de Cañas also contains the Meeting Log dated February 24, 2022, stating that ‘…residents of Barrio San Martín de Cañas are initially received, and they describe a problem involving wastewater discharge and suspected sewage…, which causes them financial losses, foul odors, and environmental health problems. They are informed of the interests of this Comisión de Aguas Residuales and its short-, medium-, and long-term objectives. They demand an immediate solution through interinstitutional intervention and request a new meeting within 15 days to address the matter with the Jefatura Regional del AyA.’ (Pages n° 00157, 00158 expediente Comisión de Aguas Residuales de Cañas). SIXTH—Accordingly, on March 11, 2022, a meeting was held in the presence of the residents of Barrio San Martín and Lic. Nombre03, director regional del AyA, thereby fulfilling the agreement made by the institutions involved with the residents of Barrio San Martín; the reported site was also visited jointly.

It should be noted that AyA explains that additional services cannot be connected to the existing sanitary sewer system (alcantarillado sanitario) in Cañas because the connection capacity of the Wastewater Treatment Plant (Planta de Tratamiento de Aguas Residuales) has been reached and, due to a lack of financial resources, the plant cannot be expanded. During that visit, the representatives of Barrio San Martín stated that they would request an opinion from the dirección de aguas to determine whether the affected stream has permanent flow. (Pages n° 00159, 00160, 00161 expediente Comisión de Aguas Residuales de Cañas). SEVENTH—As a follow-up, on April 26, 2022, a meeting was held with the members of the Comisión de Aguas Residuales, at which the Médico de Sección de Departamento del Área Rectora de Salud Cañas of the Ministerio de Salud explained the difficulties encountered when visiting homes to verify their conditions following complaints.

The Ministerio de Salud issues the corresponding Health Orders; however, a solution is feasible only when people have space to improve or expand their drainage systems, while in other cases it is impossible because the entire property has been built upon, in addition to the fact that the soil has low permeability in some sectors. As a proposal, it was suggested that a joint document be prepared—as the Comisión de Aguas Residuales—for submission to the Asamblea Legislativa and presentation to the senior officials of AyA and the Ministerio de Salud in pursuit of a collective solution, because individual solutions would not resolve the problem given the urban characteristics mentioned by the petitioner. The sanitary sewer system must be expanded, and the oxidation ponds (lagunas de oxidación) must be improved in order to expand services. It should be noted that the Cañas sanitary sewer system is the only combined system in the country: it collects both stormwater and sewage, and during the rainy season, when rainfall is heavy, it overflows, causing the waters to mix and generate foul odors.

AyA (not included in this amparo proceeding) must therefore urgently add to its project portfolio the technical studies needed to design a new sanitary sewer system for Cañas so that this problem, which affects not only Barrio San Martín but also other neighborhoods in the canton, can finally be resolved. Hence the decision of the Comisión de Aguas Residuales to present the matter at the highest level, because at the local and regional levels AyA cannot, as a matter of policy, prioritize a project of this magnitude, while the Ministerio de Salud’s issuance of Health Orders as individual solutions and imposition of fines on individuals would not solve the larger problem. Furthermore, over the years the Municipalidad has failed to inspect construction to ensure that it is carried out in accordance with the plans submitted and to prevent the population from undertaking construction without the required permits, as we have verified during many inspection visits. (Pages n° 00169, 00170, 00171, 00172 expediente Comisión de Aguas Residuales de Cañas).” 3. Nombre04, in her capacity as Alcaldesa de Cañas, reports under oath as follows:

“This municipal administration, through the mayor’s office, has always safeguarded the social and environmental development of the cantón de Cañas in the specific areas of environmental well-being, in conjunction with the protection of public health, as in the matter before us, being aware of the problems experienced by the communities located west of the urban center, in the neighborhoods of La Unión and San Martín, due to the course of the stream (quebrada) known as “Poza de Agua,” which begins in the eastern sector of the urban center and follows its natural course from east to west, passing at various points through the neighborhoods of La Unión and San Martín. It then continues along its natural course to the properties located entirely to the southwest, where it follows its natural channel (cauce natural) until joining quebrada Florentina. In order to maintain a healthy environment and comply with the Plan Anual Operativo Ambiental, which is intended to identify alternatives, processes, tools, ideas, and projects aimed at improving conditions and raising public awareness so that actions can be undertaken without adversely affecting the environment, during 2021 requests were addressed from residents of the communities of San Martín and Barrio Unión for the cleanup of the areas surrounding quebrada Poza de Agua.

Under the powers granted by the supreme Constitutional Law, the Código Municipal, and supplementary laws such as the Ley General de Caminos Públicos, municipalities are responsible for the construction and maintenance of the cantonal road network. Accordingly, in exercising this authority in furtherance of the public interest, the Municipalidad proceeds, through the procedures established for public procurement (contratación pública), to contract for and maintain the cantonal road affected by the natural passage of quebrada “Poza de Agua,” which has been documented since the 70° as an intermittent stream (quebrada intermitente) affecting private properties and public roads located along its natural path or course, flowing from the east through the west and continuing southwest of the urban center. Regarding the appellant’s statement concerning the increase in the flow rate (caudal) of the body of water running through what the appellant calls “poza de agua,” allegedly due to the purported approval by the respondent Municipalidad of the expansion of Ruta Uno, this municipal administration, through the mayor’s office, responds to the claims made by the appellant and demonstrates that the appellant is mistaken, because the body of water mentioned has existed since well before the seventies.

That body of water originates east of the urban center and continues across the urban center toward the southwest, passing through the neighborhoods aligned from east to west (Dirección04 and San Martin), discharging into the properties located to the southwest and joining quebrada Florentina. The Costa Rica topographic map sheet (hoja cartográfica) 067 Cañas, scale 1:50000, issued by the Instituto Geográfico Nacional (IGN), shows the presence of a body of water that begins in the sector east of ruta 1, crosses that route, and continues westward through barrio San Martín, thereafter following its course southwest for approximately 4 km until converging with Quebrada Florentina (see detail in image C-03). The geospatial information available from the Dirección de Aguas in the public viewer of the SINIGIRH platform shows that, west of Dirección01, there is an unnamed stream that is a tributary (afluente) of Quebrada Poza de Agua.

Satellite images identified as C-1 and C-02, corresponding respectively to satellite images from 2007 and 2017, show evidence of a body of water. In image C-04, the Departamento de Catastro de la Municipalidad de Cañas prepared an overlay of cadastral plans (planos catastrados) adjoining the drainage ditch (acequia) that runs from Dirección05 through Barrio San Martín until discharging into an unnamed stream that is a tributary of quebrada poza de agua. Several reference cadastral plans showing the drainage ditch are attached and are identified in red in image C-04. The following provisions govern the use established by current regulations for drainage ditches, streams, and rivers as outlets for rainwater (aguas pluviales), the management of which falls within municipal authority: 1- Pursuant to article 121 of the Reglamento de Construcciones del INVU, rainwater from buildings must be discharged into storm sewer systems (sistemas de alcantarillado pluvial) or natural watercourses (cauces naturales), or may be reused, provided that it is not used for human consumption.

Similarly, article 42 of the Reglamento de Fraccionamientos y Urbanizaciones del INVU states: “…In every urban development project (proyecto de urbanización), rainwater must be conveyed to a storm sewer system that, through pipes, conduits, and other ancillary works, ensures the discharge of rainwater to natural disposal sites.” Therefore, there is no prohibition against discharging rainwater into natural watercourses. Regarding the appellant’s allegation concerning the purported lack of oversight and compliance with the regulations governing the urban-planning conditions (condiciones urbanísticas) that wastewater and rainwater must meet in the western area of the urban center (Dirección04 and San Martín), as the active local administration with authority to regulate and oversee urban growth, we demonstrate that the appellant’s allegations are unfounded, because, as part of the process for approving building permits (permisos de construcción), officials of the Departamento de Desarrollo y Control Urbano de la Municipalidad verify in the construction plans that wastewater (aguas residuales) from buildings is in fact discharged into a treatment system—either a septic tank (tanque séptico) or treatment plant (planta de tratamiento)—and not into the storm sewer system.

Likewise, progress inspections (inspecciones de avance) are conducted during the construction process, and whenever any modification is detected, the Ministerio de Salud is notified so that it may proceed within the scope of its authority. Furthermore, article 118 of the Reglamento de Construcciones del INVU provides that “wastewater must be treated and disposed of through a sanitary sewer (alcantarillado sanitario), septic tank, or treatment system that complies with the Reglamento de Aprobación de Sistemas de Tratamientos de Aguas Residuales, Decreto Ejecutivo N°39887- SMINAE and its amendments, or any regulations replacing it. The discharge of wastewater into the storm sewer system is prohibited….” Similarly, article 37 of decreto 42075-S-MINAE states: “The discharge of effluent (efluente) from septic tanks into a body of water, storm sewer, or any other element that does not lead to a drainage system (drenaje) or an additional treatment unit before final discharge is not permitted.

Wastewater overflows from drainage systems are not permitted.” Because this matter also involves the responsibilities falling within the authority of other State institutions, it is important to emphasize, with respect to wastewater, that decreto 42075-S-MINAE assigns responsibility for wastewater matters to the owner and the responsible professional (profesional responsable) in article 12, stating that “the property owner and the responsible professional shall be jointly responsible for the design and operation of the pretreatment system (sistema de tratamiento previo) and the drainage system, whether it consists of a septic tank or a wastewater treatment plant. Any change to the design of the treatment plant, septic tank, or drainage system must be expressly authorized by the Ministerio de Salud before construction work begins.” Detailed report on the actions undertaken by the Departamento de Gestión Ambiental in performing cleanup maintenance within quebrada “Poza de Agua” in the Barrio San Martín sector. 1- During 2021, cleanup work was performed around and within quebrada “Poza de Agua” where it passes through barrio San Martín.

It is important to emphasize that this cleanup work was always conducted in compliance with the current regulations concerning the protection of streams, rivers, and springs (nacientes), and focused on eliminating standing water (estancamiento de aguas) at the site—within quebrada “Poza de Agua”—by manually moving sediment, stones, shrubs, and certain non-recoverable waste (residuos no valorizables) that obstructed the flow of water, especially during the summer, when quebrada “Poza de Agua” has a lower flow rate. This caused rainwater—resulting from the sudden and intermittent rainfall occurring in the mountains to the east—that naturally flows along the stream channel to remain stagnant where it passes through Barrio San Martín. 2- It is important to note that the cleanup work did not disturb any embankments (taludes) adjoining properties in a manner that would have widened the natural channel of quebrada “Poza de Agua.” Detailed report on the actions undertaken by the Departamento de Unidad Técnica de Gestión Vial in maintaining the cantonal road in accordance with current legislation at the point where quebrada “Poza de Agua” passes through the Dirección01 sector. 1.

As part of the 2021 fiscal year, specifically under the extraordinary budget, resources were allocated to create the project entitled “Rehabilitation of the Existing Culvert Crossing Over a Stream at Dirección06° in Barrio Unión of the City of Cañas” (“Rehabilitación De Paso De Alcantarilla Existente Sobre Quebrada En Dirección06° En Barrio Unión De La Ciudad De Cañas”), at coordinates 10°25¨37” Nombre01 85°06¨06” W (see Illustration N°1 of report OFC-DIV-049-22). 2. Following approval of the resources, field visits and preliminary studies were conducted to determine the type of work to be performed. It was observed that the problem at the site arises mainly because, given their elevation, the existing structures (headwalls [cabezales]) cause erosion of the roadway surface (superficie de ruedo), leaving only one lane available for vehicular traffic; furthermore, because there is no pedestrian bridge, people must walk along the street, creating a hazard for users.

(See Illustrations N° 2 and N°3.) 3. It is important to mention that all work must be built within the right-of-way (derecho de vía) and will be used to convey rainwater, even though other types of water already flow at the site. (See Illustrations N° 4 and N°5 OFC-DIV-049-22.) 4. In view of the existing need and with the approved resources, the public bidding process (proceso licitatorio) for the work was initiated through Licitación Abreviada 2021LA-00009-01, entitled Construction of Simple Headwalls, Winged Headwalls, Low Walls, Slabs, and Other Works at Culvert Crossings on Roads in the Cantón (“Construcción de cabezales sencillos, cabezales con aletones, muretes, losas y otras obras en pasos de alcantarilla en caminos del cantón”), resulting in Purchase Order N°19284 and contract 014-2021. 5. At the beginning of febrero del año 2022, the notice to proceed (orden de inicio) with the work was issued, resulting in the widening of the roadway to 2 vehicular lanes and, additionally, the construction of a cantilevered bridge (puente en voladizo) to provide continuity for the pedestrian sidewalks, thereby ensuring user safety.

All of this was done without modifying or altering the existing quebrada “Poza de Agua,” nor is any additional water being discharged into the outlet channel (canal de desfogue). In fact, the work merely improves vehicular and, principally, pedestrian traffic conditions at this specific location, which falls within the authority entrusted to the Municipalidad. (See Illustrations N° 6 and N°7 OFC-DIV- 049-22).” 4. By a ruling issued at 07:24 hours on 22 de agosto de 2022, the Reporting Justice (Magistrada Instructora) granted a hearing to the Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados.

5. Nombre05, in their capacity as Deputy General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, states under oath as follows:

FIRST: Based on report GSP-RCHO-2022-02688 from AyA’s Región Chorotega, it is stated: “..With regard to the technical status of the collection and treatment service at the location at issue and in additional sectors, it is indicated that additional services cannot in fact be connected to the existing sanitary sewerage system (alcantarillado sanitario) in Cañas because the connection capacity limit of the Wastewater Treatment Plant (Planta de Tratamiento de Aguas Residuales) and its treatment capacity have been reached; and, given the scale of the project required, the necessary resources are not available for its formulation, design, expansion or construction, operation, and maintenance. The complainant’s site is outside AyA’s current service coverage, and the matter described is beyond our jurisdiction. The following image shows the location of Barrios Unión and San Martín and the sanitary sewerage network…

Regarding the facts and allegations submitted in both amparo proceedings (recursos de amparo), it must be noted that AyA is indeed aware of the existing problems concerning the wastewater sanitation needs of several sectors of the Cantón de Cañas that are not part of our Institution’s service area, since, of all the drinking-water services comprising the Sistema de Agua Potable de Cañas, wastewater networks cover only 25%. In that regard, in the exercise of its governing role, AyA has participated in various working sessions convened through the Comisión de Aguas Residuales de Cañas, at which the specific cases of the neighborhoods giving rise to the problem at issue here have been addressed. Strictly within the powers and responsibilities assigned by law, AyA has provided this commission with technical advice in the search for a permanent solution for wastewater sanitation in the Cantón de Cañas.

It is important to reiterate to the honorable Sala IV that the neighborhoods at issue are outside the service area of the services provided by AyA and therefore do not have institutional approval for the sanitation solution selected in the urban development projects that gave rise to Barrios Unión and San Martín, Pedregal, and Bello Horizonte. It must likewise be reiterated that, by statutory mandate, AyA guarantees service for systems within its service area to the extent legally and technically feasible, provided that all requirements established for such purposes are met. It is also appropriate to mention that Costa Rica has constitutionally recognized the right to decent housing, as well as the rights to education and health. Notwithstanding the foregoing, it is important that the honorable Sala Constitucional take into account that none of the circumstances of the persons living in the neighborhoods at issue, as described by the petitioner, entitles them to disregard compliance with all requirements established by law for the development of real-estate development projects.

Rather, it would appear that the aim is to invoke their circumstances in order to obtain the approval of Institutions such as those involved here and thereby consolidate the establishment of settlements that appear to have been built without observing Costa Rican construction standards, endangering the physical integrity and health of their residents. It is vital that the honorable Sala IV consider that Ley de Salud Pública No. 5395 provides as follows: Article 308.- Without prejudice to the powers of other authorities or entities with jurisdiction over the matter, every person engaged in the urban development of land and the construction of residential buildings shall comply with the provisions of the health regulations issued on the subject by the Ministerio in order to protect human health. Article 310.- The construction of housing in new urban developments or subdivisions (loteos) of larger properties whose services and sanitation systems do not comply with applicable statutory and regulatory provisions is prohibited.

Article 311.- The same rules established in the preceding articles shall apply to the establishment of new cities or communities. Article 313.- Every individual, single-family, or multifamily dwelling shall meet the following health requirements: .(…) 8. Basic sanitation facilities: a) A continuous supply of drinking water, in sufficient quantity and at sufficient pressure, accessible to all occupants. b) Adequate systems for the disposal of excreta, sewage, wastewater, and stormwater, approved by the health authority. c) Minimum primary sanitary fixtures.” (emphasis added) Accordingly, allowing situations such as the one at issue here would pose a grave risk to legal certainty in our country, because an attempt is apparently being made—through an amparo proceeding and the authority of the honorable Sala Constitucional—to secure access to basic services (through a public source or by any other means) for a property on which dwellings or settlements have been developed without due process in construction matters and therefore without complying with the requirements established by law.

Ultimately, this instead increases the health risk to the persons living in those dwellings, both because of the danger inherent in living in a dwelling erected without regard to the Código Constructivo de Costa Rica and because it would be made habitable without verifying how its wastewater is disposed of. It is respectfully reiterated that, if it is established that a particular property lacks an adequate wastewater-disposal system for reasons beyond the Institution’s control, an institution such as ours should not be compelled to provide service to persons living in sectors outside the coverage of our systems when there is no technical and legal feasibility (factibilidad técnica y legal) for providing those services. In light of the arguments presented, it may be reiterated that the San Martin, La Unión, Pedregal, and Bello Horizonte projects do not have access to collection and treatment services; they were therefore developed using other sanitation alternatives regulated by the Municipalidad to ensure the proper construction of the systems (individual disposal and treatment) and oversight in accordance with Ley General de Salud.

(…) To respond to the Dirección02 case, it is necessary to provide the following review of both historical and technical information: 1. The Cañas sanitary sewerage system dates from the 1960s, and the Cañas lagoons—specifically Laguna San Cristobal—have been mentioned in the literature since 1958. 2. The sanitary sewerage system covers part of the central district of Cañas, rather than the entire area receiving drinking-water service. This means that only a small percentage of the population enjoys this benefit. (Figure No.2. Drinking-water coverage in blue, wastewater coverage in yellow, Dirección07 in red.) 3. The sanitary sewerage system is combined. This means that both wastewater and rainwater—the latter being under the jurisdiction of the Municipalidad rather than the Institution—flow through the same pipe. This is the only sanitary sewerage system of its kind in the country. Cañas served as an example of what should not be done because, in this tropical country with very high rainfall intensities and climate change, it exceeded its design capacity many years ago. 4.

Septic tanks (tanques sépticos), which are used throughout the remainder of the area shown outside the sanitary sewerage system’s service area, fall primarily under the responsibility of the Ministerio de Salud and, secondarily, the Municipalidad de Cañas. Once these premises and their effects on technical matters and the growth of Cañas have been established, it is important to clarify why no connections other than those resulting from natural growth have been permitted. Figure No.2 shows that, from the very conception of the sanitary sewerage system, it was technically impossible to connect that neighborhood across the drainage divide represented by the national highway; the water will plainly flow to the lowest point, which in this case is the lagoons and, farther beyond, Dirección02. Thus, it cannot be interconnected either because of elevation levels or because of the lagoons’ capacity.

Regarding the second point, it is important to state that, for more than fifty years, the Municipalidad de Cañas has had the opportunity to conceptualize and construct a storm sewerage system (alcantarillado pluvial), thereby not only helping to improve living conditions in the Cantón de Cañas but also reducing pollution in that city. From a technical standpoint, opening the stream consists of creating a channel through which rainwater can flow toward a watercourse. However, because the septic tanks in Dirección02 are not functioning—which, as the amparo proceeding correctly states, has resulted in health orders—and because septic tanks are being bypassed so that their contents flow into the street, stormwater mixes with wastewater, increasing pollution in the watercourse opened by the Municipalidad and becoming a serious public-health problem because of odors, disease vectors, and the provisions of Article 50 of our Political Constitution, under which everyone has the right to a clean, sustainable, and pollution-free environment, unlike the current situation.

It is clarified that the source of this problem and, ultimately, of the proceeding at issue is the irregular connection of wastewater to the storm sewerage system or its diversion to curbs and gutters, from which, because of the slope and the effect of gravity, it reaches the channel regarding which residents cite the problem caused by the Municipalidad de Cañas opening a channel. This is not the only community in Cañas experiencing such problems: near the center of the canton, Bello Horizonte, La gran Piedra, and Pedregal may also be cited, as they complain that the soils do not drain. They have no sanitary sewerage solution because they are outside the service area and, when they likewise experience problems with their septic tanks and drainage fields, they divert their water to curbs and gutters. In this regard, during the meetings, the Ministerio de Salud presented the case to AyA so that the sanitary sewerage system and the wastewater-quality values of the Cañas wastewater treatment plant (PTAR) could be improved.

However, this cannot be done without first separating the sewerage systems and conducting a study and preparing a design of the existing sanitation infrastructure. A series of photographs taken last March of work performed by the Municipalidad de Cañas is shown below in the following images. It should be noted that watercourses must be opened on the basis of the requisite technical studies in order to prevent slope failures and possible harm to third parties. The photographs shown are from March, meaning that all the water pooled there is wastewater. Regarding the system’s treatment-capacity problem: One aspect of the identified problem is the aforementioned infiltration of rainwater, which not only increases hydraulic velocity in the lagoon system but also reduces lagoon retention time and carries water containing chemicals, among other substances, that the installed facultative system cannot process.

In addition to the foregoing, a second reason why the system does not comply with all statutory parameters is that the lagoons have operated for more than fifty years and continue to do so with reasonable efficiency, but the number of connections and the loads have increased, while the system has remained unchanged. Operational and maintenance efforts are what have kept the lagoons functioning.

On the other hand, the Operations Deputy Management is responsible for bringing the Cañas problem before senior management; however, within the framework of the Cañas Wastewater Commission, of which the Región Chorotega is a member through Eng. González Palma, a proposal has been prepared for the senior authorities of the Ministerio de Salud, the Executive Presidency, and the Asamblea Legislativa so that all interested parties would be aware of the problem from the perspective of those who operate the system but lack the mechanisms to make decisions concerning large-scale projects. As an initial measure, it is essential that the sewer systems be separated, since whenever it rains, this water flows into the treatment system. Other options for the affected neighborhoods must then be assessed, but it should be noted that this problem was caused by the municipal corporation, which for many years issued building permits without storm sewerage works (obras de alcantarillado pluvial) being carried out, despite its awareness of the soil problems in Cañas.

Likewise, AyA is the governing authority for sanitation, but it does not have the power to approve or disapprove the operation or placement of septic tanks (tanques sépticos). Furthermore, the existing users who connected to the sanitary sewer system (sistema sanitario) at the first opportunity without causing this problem are the ones whose service must be secured first, since conditions made that connection possible. It must be borne in mind that something cannot be expanded in the knowledge that doing so will merely transfer a problem from one sector of Cañas to another; the solution must be comprehensive and requires first removing all stormwater flow from the sanitary sewer system. Indeed, when the highway was built, the stormwater system for that route was made to discharge into our sewer system, which in itself aggravated a situation that was already delicate at the time. Technical Recommendations of the Report: 1.

Verify that the open channel is in fact a stream (quebrada). If it is not, it should not have been opened. 2. If it is, protect the banks of this channel. It may not discharge onto private property but must flow into a receiving body (cuerpo receptor). 3. The Municipality must separate the storm sewer system and shall use its best practices to plan, over the medium term, how to obtain the resources needed for that purpose. 4. Issue the respective sanitary orders (órdenes sanitarias) requiring the community of San Martín and other neighborhoods to disconnect their wastewater and refrain from discharging it into the street and, in cases where septic tanks are used, to ensure that the system is used properly and receives the corresponding maintenance. 5. Región Chorotega-AyA has already brought before senior management the need to increase the treatment capacity of the Cañas wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR) and to extend its collection networks.

This request is recorded in the report cited by the Minister of Health. From a technical perspective, AyA has used its good offices to fulfill the responsibilities falling within its jurisdiction and, in various forums such as the Wastewater Commission, has indicated a course of action that could be followed to improve the situation. However, because this is a longstanding problem requiring substantial investment and involving other institutions in every respect, it cannot be addressed by the Institution alone…” SECOND: Because the septic tanks were not properly built and did not receive proper maintenance, the residents resorted to discharging into the existing stream, a situation that worsened with the construction of the Route. It is explained that, because of the widening of Inter-American Route One, the natural channel of that body of water was altered, specifically in the western sector.

As the appellants (recurrentes) correctly state, the Municipalidad de Cañas allowed stormwater, wastewater, and sewage from the homes to be discharged into that body of water. It is reiterated that no sanitary sewer system (alcantarillado sanitario) is in use or planned for that residential development because, since it is geographically situated at a lower elevation, it cannot be connected to the existing network. The resident property owners must therefore use septic tanks until it becomes materially possible to implement a sanitary sewerage solution through a pumping station that conveys the wastewater to the current system. The problem faced by the appellants results from the improper practices of the residents themselves, in this case within Dirección02, who failed to build their septic tanks properly or maintain them as required. The residents themselves thereby created the source of contamination affecting the appellants by discharging both stormwater and wastewater into a body of water, without the corresponding authorization from MINAE and with the acquiescence of the Local Government itself.

Because the problem is located within private property—the septic tanks—where AyA cannot intervene, since it falls within the private sphere, it is the responsibility of the MINISTERIO DE SALUD, pursuant to the powers conferred on it by law, to order the property owners in Barrio San Martín to immediately cease the pollution they are causing. Developers engage in the improper practice of constructing their developments with septic tanks without knowing whether the land being developed has the infiltration and geological conditions necessary for septic-tank use, because such a system is less expensive than a wastewater treatment plant. They also leave a buried pipe that does not connect to any AyA collector sewer (colector) or subcollector sewer (subcolector); it is merely a pipe left in place by developers so that, if AyA later installs wastewater pipes nearby, they can connect their developments to the AyA network.

They do this without AyA’s approval. As already stated, Barrio San Martín never approached AyA to have any of its development stages analyzed. In accordance with its powers, the MINISTERIO DE SALUD has issued sanitary orders requiring all residents of Barrio San Martín to ensure that their septic tanks operate properly, an action that must be carried out until the Sanitary Sewerage Project (Proyecto de Alcantarillado Sanitario) can be built. Septic-tank systems constitute an alternative technology to traditional collection networks and are used nationally and worldwide as a suitable option for the proper treatment and disposal of wastewater, particularly in places where sanitary infrastructure does not exist or where the terrain’s topography makes connection to the collector sewers administered by AyA infeasible, as is the case for the appellants. In Costa Rica, 70% of wastewater is disposed of and treated using septic-tank system technology, and property owners must provide appropriate maintenance and refrain from building over the drainage system’s absorption and aeration areas.

Septic tanks are a technical solution to the wastewater problem, provided they are built according to the design and characteristics of each soil. In the case of domestic wastewater, the septic tank must receive water from the kitchen sink, laundry sinks, washing machine, showers, washbasins, and toilets. It is important to emphasize that all wastewater we generate must be collected through a dedicated pipe inside the home and disposed of in the septic tank. A properly constructed and designed septic tank with an adequate drainage system requires cleaning every 6 months or every year, depending on the number of people living in the home, to remove the sludge that has settled and accumulated at the bottom of the tank. Because they lacked properly functioning septic tanks, the appellants found it easier to dispose of all their wastewater into a body of water and ask the Sala Constitucional to order AyA to connect them to an AyA wastewater system, without considering—or because they are unaware—that this is not the solution at present, since a series of design, budgeting, planning, and contracting stages must be completed before a Sanitary Sewerage Project can be implemented.

When each of the residents purchased their homes, the homes had a septic tank that they are required to maintain every 6 months. Their own neighbors are discharging polluted water into the body of water and contaminating the environment. If the residents of Dirección02 do what is required, this appeal has no basis: if every resident has a septic tank on their property, has connected the wastewater from the kitchen sink, laundry sinks, washing machine, showers, washbasins, and toilets to it, and maintains it properly, this wastewater problem would not exist. Furthermore, they are attempting to hold the State responsible for what their neighbors have failed to do for years. Through a ruling of the Sala Constitucional, they seek to shift responsibility to the Costa Rican State while allowing the residents to go unpunished even though they are responsible for the pollution they are generating, thereby evading the responsibility that every Costa Rican has toward the environment and exposing their own families and neighbors to a public-health problem.

To reduce the public-health risk being caused by the appellants’ neighbors, the MINISTERIO DE SALUD must continue identifying the residents who are causing pollution and issuing the corresponding sanitary orders so that they properly connect the wastewater from the kitchen sink, laundry sinks, washing machine, showers, washbasins, and toilets to the SEPTIC TANK and stop discharging their wastewater into the existing body of water until the Sanitary Sewerage Project—which will benefit Bello Horizonte, La Gran Piedra, Pedregal, La Corte, Los Malinches Barrio Chorotega, Las Palmas, El Bosquecito, San Antonio, Barrio Unión, San Martín, Las Cañas, Villa Esperanza, Miguel Araya, San Cristóbal Sur, Imas, and Barrio San Martín—can be implemented within the applicable financial, contracting, and construction constraints. THIRD: AyA cannot invest in the septic tanks located within the properties of Dirección02 because our institution is governed by the LEY DE LA ADMINISTRACIÓN FINANCIERA DE LA REPÚBLICA Y PRESUPUESTOS PÚBLICOS, No. 8131 de 18 de setiembre del 2001, Published in La Gaceta No. 198 de 16 de octubre del 2001.

We cannot overlook the fact that approval of the budget determines the legality of public expenditures. As a legal rule, the budget governs the financial activity of public expenditure for the corresponding fiscal year and therefore limits the actions of the Public Authorities in the use and disposition of public funds. Pursuant to Article 176 of the Constitution, the budget constitutes an act of mere forecasting or accounting calculation with respect to revenue, whereas with respect to public expenditures it retains a threefold effect: authorization of expenditure, limitation of the amount to be spent, and determination of the purpose for which the appropriations approved in the budget are to be used.

The foregoing derives from the Principle of Legality (Principio de Legalidad) enshrined in Article 11 of the Political Constitution and also developed in Article 11 of the General Law of Public Administration; as is well known, the principle of legality under the rule of law (estado de derecho) establishes a special form of subordination of public authorities and institutions to the legal system, based on its fundamental definition, according to which every public authority or institution is such and may act only insofar as it is empowered to do so by that same legal system, normally through express provisions—for public authorities and institutions, only that which is expressly authorized by the Constitution and the law is permitted, and everything not authorized is prohibited—as well as its two most important corollaries, still within a general framework: the principle of minimum regulation (principio de regulación mínima), which imposes special requirements in procedural matters, and the principle of statutory reservation (reserva de ley), which in this field is nearly absolute.” (Sala Constitucional.

Resolution No. 440-98, and similarly Nos. 5541-97 and 1739-92). Official Letter 12956 of 24 de noviembre de 2003 (DAGJ-1719-2003). The foregoing must be complied with pursuant to law, and the owners must use and maintain the septic tanks until the Sanitary Sewerage Project under the responsibility of AyA and the Stormwater Sewerage Project under the responsibility of the Municipalidad can be implemented. FOURTH: Pursuant to Article 169 of the Political Constitution, the Municipalidad must safeguard the interests of all inhabitants of the Canton; accordingly, Article 50 of the Political Constitution requires the Municipalidades to guarantee the greatest well-being of the citizens of the Canton by fostering development toward a fair distribution of wealth within a healthy and ecologically balanced environment, and Article 11 of the Constitution therefore requires that Municipalidad and its officials to submit to accountability (rendición de cuentas) and evaluation of results, as required under Article 129 of our Political Constitution.

Article 169 of the Political Constitution and the Municipal Code state that the MUNICIPALIDAD is the Territorial Entity responsible, originally and primarily, for ensuring compliance with obligations relating to local interests and for implementing the actions necessary for the development of activities within its canton, which fall within its exclusive jurisdiction. FIFTH: As shown by the evidence in the case file (expediente), through the minutes of 24 de junio 2022, CTAR-CÑ-0001-2022, the Instituto stated: “…..2 At the level of Acueductos y Alcantarillados (AyA), both locally and regionally, it does not have the financial resources to design, expand, and construct a new sanitary sewerage system in Cañas and suggests, among other things, the ‘separation of the Stormwater Sewerage System by the Municipalidad, which must plan, over the medium term, to secure resources for this purpose.’ It also recommends ‘that Región Chorotega-AyA submit to Senior Management the need to increase the treatment capacity of the Cañas WWTP (PTAR Cañas) and extend its collection networks,’ as well as ‘preparing a joint report to bring the existing problems in Cañas before the various authorities.’ This is because many neighborhoods surrounding the city center lack sanitary sewerage and have wastewater problems that continually lead to complaints and even constitutional-amparo proceedings (recursos de amparo). 3.

AyA likewise reports that: ‘as of April 2022, 7214 drinking-water services are active; as regards the provision of sanitary sewerage and wastewater and excreta treatment services, it currently has approximately 24.54% coverage. The remaining 75,46% have sanitation services such as septic tanks or septic pits, latrines, or no coverage whatsoever,’ and ‘according to the DATAMART2 commercial system, drinking-water and sanitary-sewerage coverage by rate type is detailed as follows: (…) 6. Although the current regulations provide legal tools, such as Article 12 of Decree No. 42075-S-MINAE, which assigns responsibility for the design, operation, and modifications of the wastewater treatment system to both the property owner and the professional responsible for the construction work, the problems in Cañas encompass long-standing structures; it is therefore materially impossible to apply this article without harming the residents of those homes, because any administrative acts (actos administrativos) that the institutions may apply are directed at the property owners rather than the professional responsible for the work. 7.

Another important factor is that the recommendation to separate the stormwater sewerage system from the existing sanitary sewerage system does not ensure that the underlying problem will be resolved, since the problem extends beyond the geographic areas connected to this network. Furthermore, resolving this problem is materially impossible for AyA, RCH, and the Municipalidad de Cañas alike; a project must therefore be formulated with a budget allocated at the central level to assist both the Municipalidad and AyA in carrying it out. 8. As stated in the first section of this agreement, this problem is evident, although not exclusive, in the first district of the canton of Cañas, with the following sectors being most affected: Bello Horizonte, La Gran Piedra, Pedregal, La Corte, Los Malinches, Barrio Chorotega, Las Palmas, El Bosquecito, San Antonio, Barrio Unión, San Martín, Las Cañas, Villa Esperanza, Miguel Araya, San Cristóbal Sur, Imas…” The Stormwater System must be created and separated, under the responsibility of the Gobierno Local, from the existing Sanitary Sewerage System, because the Sanitary Sewerage System is not designed to receive stormwater flows, a situation that the Gobierno Local has facilitated by allowing such connections to the existing sanitary system, with the result that during natural rainfall-flow events, the existing capacity of the sanitary piping is exceeded, consequently affecting the Treatment Plant.

SIXTH: The current status of the Cañas-Guanacaste Sanitary Sewerage Project is described on the basis of report SB-AID-2022-00381 of the Subgerencia de Ambiente Investigación y Desarrollo. “…document CTAR-CÑ-001- 2022 states: As a result, the Presidencia Ejecutiva requested the participation of the Dirección Diseño de Saneamiento of the UEN Programación y Control at the latest meeting of the interinstitutional commission, held on 4 de agosto, at which it was agreed to propose a road map for addressing the problems in Cañas involving the combined sewerage system (wastewater and stormwater). The following matters will be among those assessed in this road map: Response strategy. To address the aforementioned problems, with due consideration of the potential technical, economic, and environmental implications of this situation, the following road map will be proposed: 1. Define the baseline studies to be conducted to diagnose the current conditions. 2.

Establish the specific studies required to determine the project’s feasibility, considering its two components: sanitary sewerage and stormwater sewerage. 3. Formulate the actions necessary to contract for the required feasibility study and preliminary designs. 4. Specify the minimum work required to contract for the detailed design of the sanitary-sewerage and stormwater-sewerage works. 5. Establish parallel tasks to ensure the project’s viability: a. Land acquisition b. Establishment of easements (servidumbres) c. Additional studies d. Permits e. Environmental viability (viabilidad ambiental) 6. State the need to arrange financing for each of the aforementioned phases. 7. Propose the parties responsible for each phase or subphase according to the work to be performed. 8. Develop a joint proposal setting out the estimated costs of each major task and the corresponding timeframe for its planning and execution, taking into account prior experience with similar processes.

Because this is a comprehensive project of great technical complexity, work is underway on a baseline proposal that will be strengthened by contributions from each institution, with the understanding that the solution must be developed gradually and in accordance with the available financial and technical resources. This strategy was to be presented to the Commission around 7 de setiembre; however, the complete inputs are not yet available. It should be noted that, depending on the strategy’s approval and the definition of timeframes and responsible parties, specific actions may be established to develop a tentative project schedule. For the time being, however, it is not possible to provide a date for execution of the works or commencement of the pre-investment phase (fase de pre-inversión). Finally, it is clarified that the execution of these activities is not the sole responsibility of our institution and that they must be addressed jointly with the Ministerio de Salud and the Municipalidad de Cañas…” ANALYSIS OF THE MERITS (ANÁLISIS DE FONDO): Pursuant to Article 1 of the Ley Constitutiva de AyA, the Instituto is responsible for administering and operating aqueduct and sanitary-sewerage systems; with respect to stormwater sewerage, however, the legislature retained that authority under the responsibility of the Gobiernos Locales, except in the case of national routes, for which responsibility for stormwater drainage lies with CONAVI.

Those entities bear full responsibility for ensuring that the stormwater sewerage system operates under appropriate conditions and for complying with the technical regulations issued in this area by AyA, by virtue of AyA’s governing authority (rectoría) in this field. Although the Sala Constitucional has repeatedly held that municipal autonomy precludes the exercise over Gobiernos Locales of governing powers originating from the Gobierno or other public-sector entities, it has also held that this autonomy is relaxed in cases involving a public-health or environmental problem in deference to a higher interest such as those cited, and those technical regulations must therefore be observed. Costa Rica has two separate sewerage systems: one known as the “Stormwater Sewerage System,” whose purpose is to convey rainwater from the roofs, gutters, and downspouts of homes, as well as rainwater flowing along public roads; and the other known as the “Sanitary Sewerage System,” whose purpose is to convey only wastewater from washbasins, sinks, showers, and toilets generated inside homes.

Under the regulations currently in force, stormwater-sewerage systems are administered by the municipalidades of each canton, while the sanitary-sewerage system is operated and maintained by the operator responsible for providing drinking-water service within its respective geographic coverage area. The Gobiernos Locales, for their part, have the authority to impose a series of restrictions on buildings and projects through urban planning (planificación urbana); notably, where the conditions they impose are not met, they have a series of coercive mechanisms to enforce their orders, which AyA lacks. In addition, it is clear that the Municipalidades are the entities that collect the corresponding amounts for the maintenance and proper operation of the Stormwater Network, as provided in Municipal Code No. 7794, Title IV, Municipal Treasury, Chapter II, Municipal Revenues.

In the present case, it cannot be overlooked that, when Municipalities collect municipal taxes, they include the charge corresponding to the maintenance and operation of the stormwater drainage system (red pluvial), which underscores municipal jurisdiction in this area; moreover, it is evident that this charge should be used for the maintenance and operation of each Municipality’s stormwater drainage system, as stated by the Constitutional Chamber (Sala Constitucional) in Voto 2001-2320, in Considerando IV, which reads verbatim: (…) Likewise, the General Health Law No. 5395 provides as follows in Articles 285 and 292: “ARTICLE 292.- The discharge of sewage, wastewater, and industrial waste into the storm sewer system (alcantarillado pluvial) is prohibited in all cases. The Ministry is authorized to restrict, regulate, or prohibit the disposal of non-biodegradable synthetic products through excreta, sewage, and wastewater collection systems.

ARTICLE 285.- Excreta, sewage, wastewater, and stormwater shall be disposed of properly and hygienically in order to prevent contamination of the soil and natural water sources intended for human use and consumption, the formation of breeding grounds for disease vectors, and air pollution through conditions that compromise its purity or quality.” In the same vein, Article 1 of Construction Law (Ley de Construcciones) N° 833 provides that: “The Municipalities of the Republic are responsible for ensuring that cities and other population centers meet the necessary conditions of safety, sanitation, comfort, and beauty in their public thoroughfares and in the buildings and structures erected on land located therein, without prejudice to the powers granted by law to other administrative bodies in these matters.” The foregoing demonstrates the connection between municipal obligations concerning storm sewer systems and the obligation stated above, which are interrelated and fall under the administration of Local Governments as part of the services they are required to provide.

Pursuant to Article 169 of the Political Constitution (Constitución Política), the Municipality must safeguard the interests of all inhabitants of the Canton; accordingly, Article 50 of the Political Constitution requires Municipalities to ensure the greatest well-being of the Canton’s residents by promoting development toward a fair distribution of wealth within a healthy and ecologically balanced environment, while Article 11 of the Constitution requires that Municipality and its officials to submit to accountability and evaluation of results, as required under Article 129 of our Political Constitution. Article 169 of the Political Constitution and the Municipal Code (Código Municipal) provide that the MUNICIPALITY is the Territorial Entity (Ente Territorial) primarily and originally responsible for ensuring fulfillment of obligations concerning local interests and must implement the actions necessary for the development of activities in its canton; storm sewer systems fall within its jurisdiction, except for those under CONAVI because they are located on national roads.

In view of the foregoing considerations, it must be reiterated that the storm sewer system is the responsibility of the Municipalidad de Cañas. A solution must be sought for the stormwater drainage system (sistema de evacuación de aguas pluviales) that simultaneously relieves the sewage system, so that both operate independently and without affecting or interfering with each other. It bears emphasizing that, pursuant to Article 83 of the Municipal Code, the Local Government is responsible for—and charges the corresponding fee for—cleaning, maintaining, and properly operating the stormwater drainage system, which, if it collapses due to lack of maintenance, may affect sanitation generally and the sanitary sewer system (red sanitaria). Indeed, the Municipalidad Cañas is required to ensure that its jurisdiction has an adequate storm sewer system because this matter falls within its authority; all the more so, it is responsible for ensuring that land within its jurisdiction complies with current regulations so that neighboring properties are not affected by runoff (escorrentía) or by the vulnerability of their land, or, worse still, that the physical, material, and environmental integrity of surrounding properties is not compromised by the absence of stabilization works (obras de estabilización) or stormwater disposal facilities.

AyA has no direct involvement in this type of storm sewer work, from a strictly legal standpoint and based on the principle of legality (principio de legalidad), which establishes the limits of its actions in the public service; Articles 1 and 2 of the Constitutive Law of AyA (Ley Constitutiva de AyA) authorize the Institute to issue regulations concerning storm sewer systems. Article 60 of the Organic Law of the Environment (Ley Orgánica del Ambiente) establishes, with respect to the prevention and control of pollution (…) Based on the legal background, responsibility for the storm sewer system rests with the Municipalidad de Cañas and with the Ministerio de Salud, as the entities charged with ensuring, through inspections or the corresponding health orders (órdenes sanitarias), the proper operation and disposal of wastewater, addressing unlawful connections to the storm sewer system by community residents, directing wastewater into the appropriate systems, and thereby preventing pollution.

This also requires proper waste management and disposal so that garbage does not clog the stormwater system. Based on the cited provisions, it is concluded that the MUNICIPALIDAD DE CAÑAS bears direct responsibility for determining the measures required to resolve the storm sewer problem, without prejudice to its coordination with entities capable of taking steps to ensure that the sewer system is adequate and its further duty to ensure that property owners properly use their septic tanks (tanques sépticos) until a comprehensive solution is implemented. The MUNICIPALIDAD DE CAÑAS is obligated to enforce the applicable laws and to guarantee that the area’s inhabitants enjoy a healthy and ecologically balanced environment, particularly in view of the health consequences they face because of the nature of the sanitation problem affecting them. Although the Municipality is fully aware of the problem affecting the residents of its canton, it has limited itself to confirming that the problem exists and evading its responsibility, without taking timely action to mitigate or control it.

The Municipality has not verified whether all residents have septic tanks and drainage systems. The MINISTERIO DE SALUD must continue formally notifying (apercibiendo) the residents of Dirección02, granting them a period within which to use their septic tanks correctly, make the corresponding improvements, eliminate any unauthorized connection (conexión clandestina) to the sewage networks installed along the public roadway, and order residents, where necessary, to construct or place into service an individual septic tank with the corresponding drainage system within their property; this system must have the necessary dimensions and sufficient receiving capacity to prevent environmental contamination. If these provisions are not complied with by the expiration of the period granted, the dwellings shall be declared uninhabitable and evacuated.

6. In the proceedings conducted, the legal requirements have been observed.

Justice Nombre06 drafts the opinion; and,

Considering:

I.Subject matter of the proceeding. The appellant claims a violation of her fundamental rights, stating that she is an older adult (persona adulta mayor) and a resident of Dirección01. She notes that part of a body of water (cuerpo de agua) identified as Poza de Agua flows through that community. She explains that, due to the widening of Ruta Interamericana Uno, the aforementioned pool underwent changes to its natural channel (cauce natural), specifically in the western sector. She adds that this occurred because the Municipalidad de Cañas allowed stormwater (aguas pluviales), wastewater (aguas residuales), and sewage (aguas negras) from the homes to be discharged into that body of water. She complains that the situation described resulted from the negligence of the officials of the respondent municipality, who failed to exercise proper oversight and ensure compliance with the regulations governing the urban-planning conditions that buildings in general must meet.

She asserts that this omission resulted not only in the discharge of stormwater and wastewater, but also sewage into the collection pipes that empty into the aforementioned pool. She further alleges that the municipality, using municipal machinery, carried out work to widen the stream channel, causing substantial pooling of wastewater. She maintains that the environment has become unsanitary and foul-smelling as a result of the sewage discharge, thereby creating an ideal habitat for mosquitoes and all varieties of insects, a situation affecting both Dirección02 and La Unión. She reiterates that the situation currently endured by their communities is unjust, unsustainable, and serious, given that they must withstand the stench and the danger to their health. She argues that the problem described compels them to seek protection of their right to health because of the negligence of the municipal entity, which has allowed housing development without exercising the oversight and supervision incumbent upon it or taking action to resolve the aforementioned problem.

She also states that the Ministerio de Salud is aware of the situation described but has taken no action to remedy it. She adds that they must constantly apply insecticides in their homes, with the high financial cost and adverse effects that this entails.

II. PROVEN FACTS

The following facts are deemed duly established and relevant to the disposition of this matter, either because they have been proven or because the respondent authority failed to address them, as directed in the initial order:

  • a)During 2021, the Municipalidad de Cañas responded to requests from residents of the communities of San Martín and Barrio Unión to clean the area surrounding Dirección02 (see the report).
  • b)The body of water mentioned by the appellant has existed since well before the seventies. That body of water originates east of the urban center, continues through the urban center toward the southwest, passing through the neighborhoods lying along an east-to-west line (Barrios La Unión and San Martin), and drains onto the properties located to the southwest, where it joins quebrada Florentina (see the report).
  • c)The administrative record (expediente administrativo) of the Ministerio de Salud contains complaint No. 59-2021, filed 12 de mayo del 2021 by the residents of Barrio San Martín against La Municipalidad de Cañas, which states: “…on 23 de setiembre del 2020, a complaint was filed with the local government concerning the situation that we residents are experiencing with the dry streambed that runs from Barrio San Martín to Dirección03; 100m south of Super San Andrés, the water stagnates in the channel of that stream, producing foul odors, rodents, and mosquitoes. It is filled with garbage and other waste; the water is no longer clear, but black and foul-smelling. These conditions are harmful to our community and may transmit diseases” (see the report).
  • d)The record contains a response from the Ministerio de Salud to the complainants, issued through Official Letter MS-DRRSCH-DARSCÑ-316-2021, dated 21 de julio del 2021, stating: “The matter will be referred to Municipalidad de Cañas for the corresponding cleanup. Since this is a widespread wastewater problem in your neighborhood, the situation will be addressed by the Comisión de Aguas Residuales de Cañas in order to seek a collective solution to the problem…”. The record also contains the transmittal email, copied to the municipal mayor and the Comisión de Aguas Residuales (see the report).

IV. CONCERNING THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT

First, it must be stated that the fundamental rights to health and to a healthy and ecologically balanced environment are constitutionally recognized (Articles 21, 50, 73 and 89 of the Constitución Política), as well as under the international law applicable in Costa Rica. In this regard, in Judgment N° 2006-005928 at 15:00 hours on 2 de mayo del 2006, this Court held: “(…) The right to life recognized in Article 21 of the Constitution is the cornerstone upon which all other fundamental rights of the inhabitants of the Republic rest. Likewise, the right to health is grounded in that provision of the political charter, since life is inconceivable unless human beings are guaranteed the minimum conditions necessary for an adequate and harmonious psychological, physical, and environmental balance. Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in Articles 21, 50, 73 and 89 of the Constitución Política.

Specifically, constitutional Article 50 expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of the foregoing, this Court has used the concept of ‘environmental quality’ (calidad ambiental) as a measure precisely of people’s quality of life, in conjunction with other elements such as health, food, work, and housing, noting that every person has the right to use the environment for their own development, but not without limits, because there is also a duty to protect and preserve the environment for present and future generations—the principle of sustainable development (principio de desarrollo sostenible).” Likewise, Article 50 of the Constitución Política establishes the State’s obligation to protect the environment. That provision states: “The State shall seek the greatest welfare of all inhabitants of the country by organizing and promoting production and the most appropriate distribution of wealth.

Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that violate that right and to seek redress for the harm caused. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties.” This confirms that the various public authorities have an inescapable duty to preserve, defend, and guarantee every person’s fundamental rights to health and to a healthy and ecologically balanced environment.

V. CONCERNING COORDINATION AMONG PUBLIC INSTITUTIONS IN THE COMPREHENSIVE PROTECTION OF THE ENVIRONMENT

The State—as a whole—is obligated to take the measures necessary to protect the environment in order to prevent levels of pollution, deforestation, extinction of flora and fauna, or excessive or improper use of natural resources that endanger the health of the public. For purposes of this task, the term public institution encompasses both the Central Administration—ministries such as the Ministerio del Ambiente y Energía and the Ministerio de Salud—which, by reason of their subject-matter jurisdiction, have broad participation and responsibility regarding environmental conservation and preservation and generally act through their specialized departments. Municipalities likewise bear significant responsibility for this task within their territorial jurisdiction. Given the diversity of actors that may be involved, it might be thought that this shared responsibility would cause chaos in administrative management.

Therefore, to avoid the simultaneous coexistence of spheres of authority differing in origin and nature, the duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish coordination mechanisms among the various agencies of the Poder Ejecutivo and decentralized institutions, and between those entities and the municipalities, so that they may perform the functions entrusted to them. This Chamber has previously addressed the principle of coordination between public agencies and municipalities in pursuing common objectives, stating in Judgment N.º 5445-99 at 14:30 hours on 14 de julio de 1999: “Coordination is the ordering of relations among these various independent activities, taking into account their convergence upon the same object or entity so as to make that convergence useful to an overall public plan, without eliminating the mutual independence of the acting entities.

Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, specific conduct cannot be imposed upon them. This gives rise to the indispensable interinstitutional ‘concerted action,’ strictly understood, whereby autonomous and independent centers of action agree upon that preventive and comprehensive framework, in which each performs a role with a view to a mission entrusted to the others. Thus, relations between municipalities and other public entities may be conducted only on an equal footing and must result in agreed forms of coordination, excluding any mandatory arrangement detrimental to their autonomy that would subject corporate entities to a coordination framework without or against their consent; this nevertheless permits the necessary subordination of those entities to the State and in the State’s interest (through the State’s ‘administrative oversight’ (tutela administrativa), specifically its function of reviewing legality, under its general supervisory powers over the entire sector.”

VI. CONCERNING THE RULING IN CASE FILE NO

22-012991-0007-CO. In Judgment No. 2022-23977 at 09:20 hours on 14 de octubre de 2022, the Sala Constitucional heard an amparo proceeding (recurso de amparo) whose subject matter was as follows:

“II.- SUBJECT MATTER OF THE PROCEEDING. The appellant states that she has repeatedly attempted to reach an agreement with the Municipalidad de Cañas concerning the wastewater problem affecting the canton of Cañas, which causes severe damage to her principal’s property, the environment, and the beef cattle kept at the site; however, she complains that neither the local government nor the appropriate entities have resolved the reported situation.” On that occasion, the Sala Constitucional— insofar as relevant—ruled:

“Now, a review of the case under consideration (sub judice) establishes that the respondent authorities have actively pursued the proceedings in the case, to the extent that in 2019 they created the Comisión de Aguas Residuales, composed of the Ministerio de Salud—as coordinator—the Municipalidad de Cañas—as local representative—and the Instituto Costarricense de Acueductos y Alcantarillados—which, like the Ministerio de Salud, has jurisdiction over the matter—to analyze and seek a solution to the problem affecting the canton of Cañas. It has also been established that the Municipalidad de Cañas has performed work on the stormwater system (sistema de aguas pluviales) to improve its operation and thereby prevent rainwater from stagnating and disease vectors from proliferating in ways that could affect public health; it has also constructed culvert headwalls and drainage ditches to channel stormwater to its natural watercourse, so that it does not flow along public streets or cause overflows.

The Ministerio de Salud (Área Rectora de Salud de Cañas) has issued health orders (órdenes sanitarias) to homeowners who improperly discharge wastewater (aguas residuales) and, when citizens have failed to comply, has certified and referred records (testimoniado piezas) to the Ministerio Público. In addition, the Ministerio de Salud, together with the Instituto Costarricense de Acueductos y Alcantarillados, has gathered information concerning the communities that should receive priority attention in addressing the wastewater problem in the canton of Cañas; the number of sanitary sewerage (alcantarillado sanitario) services connected to the system compared with the number of residents who lack such service; the condition of the sewer network; and the capacity of the treatment plant or treatment lagoons, among other actions. However, those actions have not been and are not sufficient, because the respondents themselves have reported that neither a local nor an individual solution is feasible and that a megaproject of considerable technical and budgetary complexity is required to resolve comprehensively the situation at issue in this application for amparo (amparo).

Furthermore, the respondent authorities reported that they had already brought the problem before the senior officials of the Ministerio de Salud, the Presidencia Ejecutiva Instituto Costarricense de Acueductos y Alcantarillados, and the Asamblea Legislativa so that they could make the appropriate decisions regarding the large-scale project required. Both the Ministerio de Salud and the Instituto Costarricense de Acueductos y Alcantarillados have also proposed a road map in the reports submitted to this Tribunal; however, they do not specify the official plan, the proposed commencement date, how the project will be implemented, or its completion date, but merely refer to possible solutions.

It is important to note that, within the scope of their authority, the respondent authorities are responsible for ensuring that proceedings are managed diligently and are under a duty to seek a prompt and effective solution to the situation at issue in the application, because it is undeniable that the reported problem could pose a threat to the fundamental right to a healthy and ecologically balanced environment. In light of the foregoing, this Tribunal finds that the fundamental rights of the applicant and the affected residents of the canton of Cañas have been violated. Accordingly, the application must be granted, as will be set forth in the operative part (parte dispositiva) of this judgment.” The operative part of the judgment ordered as follows:

The application is granted. Nombre04, in her capacity as Alcaldesa de Cañas; Nombre05, in his capacity as Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados; and Nombre07, in his capacity as Jefe del Área Rectora de Salud de Cañas—or whoever may hold those offices—are ordered to issue the pertinent directives and undertake all actions falling within the scope of their respective authority so that, within a period not exceeding THIRTY-SIX MONTHS from service of this judgment, they definitively and comprehensively resolve the problem facing the canton of Cañas (primarily in the communities of Bello Horizonte, La Gran Piedra, Pedregal, as well as La Corte, Los Malinches, Barrio Chorotega, Las Palmas, El Bosquecito, San Antonio, Barrio Unión, San Martín, Las Cañas, Villa Esperanza, Miguel Araya, San Cristóbal Sur, Imas, and Barrio San Martín) concerning wastewater.”

VII. THE SPECIFIC CASE

Based on the reports submitted by the representatives of the respondent authority—which are deemed to have been given under oath, subject to the consequences, including criminal consequences, established in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for adjudication of the matter, it has been duly established that the Cañas sanitary sewerage system is the only combined system in the country; that is, it collects both wastewater and rainwater in the same pipe (storm sewerage (alcantarillado pluvial)), which is more than forty years old, a situation known and confirmed by all the respondent authorities in their reports submitted under oath.

Now, a review of the case under consideration establishes that the respondent authorities have actively pursued the proceedings in the case, to the extent that in 2019 they created the Comisión de Aguas Residuales, composed of the Ministerio de Salud—as coordinator—the Municipalidad de Cañas—as local representative—and the Instituto Costarricense de Acueductos y Alcantarillados—which, like the Ministerio de Salud, has jurisdiction over the matter—to analyze and seek a solution to the problem affecting the canton of Cañas. It has also been established that the Municipalidad de Cañas has performed work on the stormwater system to improve its operation and thereby prevent rainwater from stagnating and disease vectors from proliferating in ways that could affect public health; it has also constructed culvert headwalls and drainage ditches to channel stormwater to its natural watercourse, so that it does not flow along public streets or cause overflows.

The Ministerio de Salud (Área Rectora de Salud de Cañas) has issued health orders to homeowners who improperly discharge wastewater and, when citizens have failed to comply, has certified and referred records to the Ministerio Público. It is important to note that, within the scope of their authority, the respondent authorities are responsible for ensuring that proceedings are managed diligently and are under a duty to seek a prompt and effective solution to the situation at issue in the application, because it is undeniable that the reported problem could pose a threat to the fundamental right to a healthy and ecologically balanced environment. In light of the foregoing, this Tribunal finds that the fundamental rights of the applicant and the affected residents of the canton of Cañas have been violated. Accordingly—in conformity with judgment No. 2022-23977 at 09:20 on October 14, 2022—the application must be granted, as will be set forth in the operative part of this judgment.

VIII. DISSENTING OPINION (VOTO SALVADO) OF JUSTICES Nombre08 AND Nombre09, AUTHORED BY THE FORMER

With all due respect, we dissent from the majority opinion granting the application, for the following reasons:

The protection of a healthy and ecologically balanced environment, under the Costa Rican legal system (Ordenamiento Jurídico Costarricense), is safeguarded not only by Article 50 of the Political Constitution, but also by a series of laws and executive decrees (regulations) currently in force, such as the Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; the Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; the Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; and Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), to name only a few. This makes it necessary, in environmental matters, to distinguish constitutional review (control de constitucionalidad) from legality review (control de legalidad). In this regard, the undersigned are of the opinion that this Chamber, through an amparo proceeding (recurso de amparo), should hear a matter alleging a violation of the right to a healthy and ecologically balanced environment only if the Administration has not yet intervened and when the violation of that right is manifest and evident, readily ascertainable, of some importance or seriousness, and directly affects a specific person or community.

Otherwise, the issue must be raised and litigated through legality review proceedings (vía de legalidad). Accordingly, mere noncompliance with obligations and duties legally imposed on the various public administrations in environmental matters is properly heard through administrative or judicial legality review proceedings, where the alleged instances of noncompliance or omissions may be examined much more comprehensively. It must be borne in mind that an amparo proceeding is a summary, informal, simple, and expedited proceeding; consequently, from the very moment the Administration intervenes in an environmental matter in the exercise of its powers and conducts a proceeding involving the issuance of administrative acts (actos administrativos), the matter falls outside the scope of this specialized jurisdiction. Therefore, review of administrative actions taken in connection with an environmental issue that requires a full evidentiary proceeding (proceso de conocimiento pleno) for its proper assessment is possible only before the ordinary courts, since the design of the amparo proceeding is incompatible with comparing or reviewing technical or legal criteria developed under the laws or regulations currently in force, or with receiving additional and more extensive evidence needed to compare or review the criteria already contained in the administrative record (expediente administrativo) for the case.

Holding otherwise would transform the amparo proceeding into an ordinary full evidentiary proceeding, thereby distorting its nature and frustrating the purposes for which it was designed, with the result that it would lose its status as an instrument for the effective protection of fundamental rights. As a consequence of the foregoing, we consider that when a public entity or body has intervened in various ways or has issued administrative acts concerning an environmental matter, its review and oversight fall within the jurisdiction of the contentious-administrative courts (jurisdicción de lo contencioso-administrativo). It is precisely verification of the existence of such administrative intervention that determines that the matter falls within the jurisdiction of legality review proceedings. Consequently, this proceeding should have been summarily dismissed, since its subject matter is an issue that must properly be discussed, analyzed, and resolved through legality review proceedings.

However, because this was not done, the proper course is to deny the proceeding without making any determination whatsoever on the merits of the issue raised, because it is for the ordinary courts—specifically, the contentious-administrative courts—to determine whether the challenged administrative acts and conduct substantively comply with the provisions of the statutory legal order concerning the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment.

IX. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced through new technologies, these must be retrieved from the Court within a maximum period of thirty business days, counted from notice of this judgment. Otherwise, any material not retrieved within this period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI and published in the Boletín Judicial N° 19, del 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

The proceeding is granted. Nombre04, in her capacity as Mayor of Cañas; Nombre05, in their capacity as Deputy General Manager of the Instituto Costarricense de Acueductos y Alcantarillados; and Nombre07, in their capacity as Head of the Área Rectora de Salud de Cañas, or whoever may hold those positions, are ordered to issue the appropriate directives and carry out all actions falling within the scope of their respective powers so that, within a period not exceeding THIRTY-SIX MONTHS, counted from notice of judgment No. 2022-23977 de las 09:20 horas del 14 de octubre de 2022, they definitively and comprehensively resolve the problem facing the canton of Cañas, specifically in Dirección02, regarding wastewater. They are warned that failure to comply with the foregoing order will constitute the offense of disobedience and that, pursuant to artículo 71 of the Law Governing this Jurisdiction, anyone who receives an order issued in an amparo proceeding that they are required to comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The State, the Municipalidad de Cañas, and the Instituto Costarricense de Acueductos y Alcantarillados are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed in proceedings to enforce the contentious-administrative judgment (ejecución de sentencia de lo contencioso administrativo). Magistrates Nombre08 and Nombre09 dissent and would deny the proceeding because it is for the ordinary courts—specifically, the contentious-administrative courts—to determine whether the challenged administrative acts and conduct substantively comply with the provisions of the statutory legal order concerning the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment. Notice shall be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del veinticinco de octubre de dos mil veintidos .

Recurso de amparo que se tramita en expediente número 22-009841-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE CAÑAS, el MINISTERIO DE SALUD y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Resultando

1. Por escrito recibido en la Secretaría de la Sala el 09 de mayo de 2022, la parte recurrente interpone recurso de amparo contra la Municipalidad de Cañas y manifiesta que: es una persona adulta mayor, vecino del Dirección01. Acota que en esa comunidad discurre parte de un cuerpo de agua que se identifica como Poza de Agua. Explica que, debido la ampliación de la Ruta Interamericana Uno, el referido pozo sufrió modificaciones en su cauce natural, específicamente en el sector Oeste. Acota que lo anterior, debido a que la Municipalidad de Cañas permitió el desfogue de las aguas pluviales, residuales y negras de las viviendas, hacia dicho cuerpo de agua. Reclama que la situación descrita, se ha dado por la negligencia de los servidores del municipio recurrido, al no ejercer el debido control y cumplimiento de la normativa que regula las condiciones urbanísticas que deben reunir las construcciones en general.

Afirma que esa omisión no sólo produjo el vertido de aguas pluviales y residuales, sino también el de aguas negras en las tuberías colectoras que desembocan en el referido pozo. Asimismo, alega que el ayuntamiento, con maquinaria municipal, realizó trabajos de ampliación del cauce de la quebrada, generando el abundante estancamiento de las aguas residuales. Sostiene que el ambiente se ha tornado insalubre y fétido, como consecuencia del vertido de aguas negras, lo que estimula el hábitat ideal para el desarrollo de mosquitos y toda variedad de insectos, situación que afecta tanto al Dirección02 como La Unión. Reitera que la situación que actualmente viven en sus comunidades es injusta, insostenible y grave dado que deben soportar el hedor y el peligro para su salud. Arguye que el problema expuesto los obliga a buscar protección de su derecho a la salud, producto de la negligencia del ente Municipal que ha permitido el desarrollo de viviendas sin el control y la supervisión que les compete, a fin de tomar acciones para resolver la problemática aludida.

Por otro lado, comenta que el Ministerio de Salud tiene conocimiento de la situación expuesta, empero no ha realizado ninguna acción para solventarla. Añade que deben estar aplicando insecticidas en sus casas constantemente, con el alto costo económico que eso implica y con la afectación que provoca. Por lo motivos expuestos, solicita a esta Sala que se declare con lugar el recurso con las consecuencias de ley.

2. Informa bajo juramento Nombre02, en su condición de Ministra de Salud, quien adjunta el oficio N° MS-DRRSCH-161-2022 suscrito por el Área de Salud de Cañas, que literalmente dice lo siguiente:

“PRIMERO- En relación a los hechos denunciados, consta en expediente administrativo abordaje de la Denuncia 59-2021, interpuesta 12 de mayo del 2021, por los vecinos de Dirección02 contra La Municipalidad de Cañas, donde se indica “…el día 23 de setiembre del 2020, se interpuso denuncia ante el gobierno local acerca de la situación que vivimos los vecinos de la sequía que cruza del Dirección02 a Dirección03, 100m Sur del Super San Andrés las aguas se estancan en el cauce de esa quebrada, produciendo malos olores, roedores y zancudos, la misma se encuentra llena de basura y otros desechos, el agua ya no es clara, sino que es negra y de mal olor. Siendo estas nocivas para nuestra comunidad y posible trasmisora de enfermedades.” Por consiguiente, consta respuesta a los denunciantes, mediante el Oficio MS-DRRSCH-DARSCÑ-316-2021, de fecha 21 de julio del 2021, donde se indicó: “Que se trasladará caso a Municipalidad de Cañas para la limpieza respectiva.

Al tratarse de un problema generalizado de aguas residuales en su barrio, la situación se tratará en la Comisión de Aguas Residuales de Cañas, con el fin de buscar una solución colectiva al problema…”. Además, consta correo electrónico de remisión con copia al alcalde Municipal y a la Comisión de Aguas Residuales (Folios n° 00001, 00002, 00003, expediente Barrio San Martín, aguas residuales). SEGUNDO- Asimismo, debo indicar que en fecha 05 agosto del 2021, trasladan de la Dirección General de Salud la misma denuncia, con el Oficio MS-DGS-3379-2021, consecutivo Denuncia 98-2021. En consecuencia, se resuelve mediante el Informe Técnico de Inspección MSDRRSCH- DARSCÑ-IT-0414-2021, de fecha 16 de agosto 2021, y con la notificación de la Orden Sanitaria MS-DRRSCH-DARSCÑ-317-2021, en fecha 17 de agosto del 2021. Y mediante el Oficio MS-DRRSCHDARSCÑ- 343-2021, de fecha 19 de agosto del 2021, se da respuesta a Oficio MS-DGS-3379-2021, y se traslada a la Comisión de Aguas Residuales, aunado al Oficio MS-DRRSCH-DARSCÑ-063-2022 respuesta a la Denuncia 098-2021.

(Folios n° 00004, 00005, 00007, 00008, 00009, 00013, expediente Barrio San Martín, aguas residuales). Tercero- En fecha 07 de setiembre del 2021, se recibe Oficio OFC-ALC- 349-2021, emitido por el Alcalde Municipal hacia los vecinos del Barrio San Martín, donde informa sobre las acciones realizadas y programadas por la Municipalidad para resolver el problema de las aguas que escurren por la zanja del antiguo campo de aterrizaje, acciones vinculadas con la Orden Sanitaria. (Folios n° 00011, 00012 expediente Barrio San Martín, aguas residuales). Cuarto- Consta en expediente de la Comisión de Aguas Residuales de Cañas, Bitácora de Reunión de fecha 14 de octubre del 2021, donde la Municipalidad de Cañas indica que se realizará limpieza del zanjo del Barrio San Martín y se realizará análisis de seguimiento. Cabe mencionar, que la Comisión de Aguas Residuales de Cañas está conformada por la Municipalidad, el AyA y el Ministerio de Salud con el fin de abordar y coordinar de manera interinstitucional problemáticas del manejo de aguas residuales del cantón.

Quinto- Además, consta en expediente de la Comisión de Aguas Residuales de Cañas, Bitácora de Reunión de fecha 24 de febrero del 2022, donde se indica que “…se recibe en primera instancia a vecinos del Barrio San Martín de Cañas, quienes exponen problemática por desfogue de aguas residuales, y sospecha de aguas negras…, lo que les genera perjuicios económicos, malos olores y problemas de salud ambiental. Se les exponen los intereses de está comisión de aguas residuales y los objetivos que tienen a corto, mediano y largo. Ellos exigen una solución inmediata a través de una intervención interinstitucional y solicitan nueva reunión para tratar el tema con la Jefatura Regional del AyA en 15 días.” (Folios n° 00157, 00158 expediente Comisión de Aguas Residuales de Cañas). Sexto- Por consiguiente, en fecha 11 de marzo del 2022 se realiza reunión con la presencia de los vecinos de Barrio San Martín y con el Lic. Nombre03, director regional del AyA, cumpliendo con el acuerdo por parte de las instituciones involucradas ante los vecinos del Barrio San Martín, además se visitó en conjunto el sitio denunciado.

Cabe mencionar, que el AyA expone que no se puede conectar servicios adicionales al alcantarillado sanitario existente en Cañas, porque alcanzaron el límite de capacidad de conexiones a la Planta de Tratamiento de Aguas Residuales, y ante la falta de recursos económicos no pueden ampliarla. En dicha visita los representantes de Barrio San Martín, indican que solicitaran criterio a la dirección de aguas para que se dictamine si la quebrada afectada es de caudal permanente o no. (Folios n° 00159, 00160, 00161 expediente Comisión de Aguas Residuales de Cañas). Séptimo- En seguimiento, en fecha 26 de abril del 2022 se realiza reunión con los miembros de la Comisión de Aguas Residuales, donde el Médico de Sección de Departamento del Área Rectora de Salud Cañas, del Ministerio de Salud explica la problemática que se enfrenta al llegar a las viviendas a verificar sus condiciones tras la presencia de las denuncias.

Como ministerio de salud se giran las órdenes sanitarias que corresponden, sin embargo, la solución sólo es viable cuando las personas tienen espacio para mejoras o ampliación del drenaje y en otros se imposibilita porque todo el terreno está todo construido, sin tomar en cuenta que en algunos sectores el suelo tiene poca filtración. Como propuesta se menciona realizar un documento en conjunto (como comisión de aguas residuales) con el fin de presentarlo ante la Asamblea Legislativa y exponerlo ante los Jerarcas de AyA y del Ministerio de Salud en la búsqueda de una solución colectiva; ya que soluciones individuales por las características urbanas mencionadas por el recurrente no resolverían el problema. Se necesita una ampliación del alcantarillado sanitario y mejoras en las lagunas de oxidación para ampliar los servicios. Cabe señalar que el alcantarillado sanitario de cañas es el único en el país que es mixto, recoge tanto aguas pluviales como negras y en invierno cuando llueve mucho colapsa, mezclándose estas generando malos olores.

Por lo que AyA (no incluido en este amparo) debe incorporar de forma urgente en su cartera de proyectos los estudios técnicos, que permitan los diseños de un nuevo alcantarillado sanitario para Cañas, para en definitiva poder revolver este problema que si afecta no sólo barrio San Martín sino también otros barrios del cantón. De ahí la decisión de la comisión de aguas residuales de exponer el caso al más alto nivel; ya que a nivel local y regional AyA políticamente no puede priorizar un proyecto de esta envergadura y ministerio de salud girando órdenes sanitarias como soluciones individuales y multado personas, no solucionaría el problema macro, debido a que también a lo largo de los años, no ha existido la fiscalización por parte de la Municipalidad para que las construcciones se ejecuten de acuerdo a los planos presentados y para que la población no realice construcciones sin los debidos permisos como lo hemos constatado en muchas de las visitas de inspección. (Folios n° 00169, 00170, 00171, 00172 expediente Comisión de Aguas Residuales de Cañas)”.

3. Informa bajo juramento Nombre04, en su condición de Alcaldesa de Cañas, en los siguientes términos:

“Esta administración municipal desde la alcaldía ha velado siempre por el desarrollo socio ambiental del cantón de Cañas en las áreas específicas de del bienestar del medio ambiente en concordancia del cuido de la salud como es el caso que nos ocupa, conociendo la problemática que vive las comunidad de ubicada al Oeste del casco urbano en los barrios de La Unión y San Martín, con el curso de la quebrada llamada “Poza de Agua” misma que inicia al sector del Este del casco urbano, atravesando con su curso natural del Este al Oeste pasando en distintos puntos por los barrios de La Unión San Martín, así mismo continua su curso natural hasta las fincas ubicadas completamente al Suroeste, siendo este su curso natural hasta unirse con la quebrada Florentina, todo dentro del cauce natural. Con el fin de mantener un ambiente sano, así como darle cumplimiento al Plan Anual Operativo Ambiental, el cual está dirigido a buscar alternativas, procesos, herramientas, ideas, proyectos que traten de mejorar y de concientizar a la población, para desarrollar acciones que no repercutan negativamente en el medio ambiente; durante el año 2021 atendieron solicitudes de parte de los vecinos de la comunidad de San Martín y Barrio Unión, para la limpieza de los alrededores de la quebrada Poza de Agua.

Dentro de las competencias otorgadas por Ley máxima Constitucional, Código Municipal, leyes supletorias como la Ley General de Caminos Públicos son las municipalidades las responsables de la construcción y mantenimiento de la red vial Cantonal, siendo así en ejecución de la competencia en pro del fin público, es la Municipalidad quien procede mediante los procedimientos establecidos para la contratación pública a contratar y dar mantenimiento a la vía cantonal que se ve afectada por paso natural de la quebrada “Poza de Agua”, misma que data desde los años 70° como quebrada intermitente afectando a las propiedades privadas y caminos públicos que se encuentren en su paso o curso natural viniendo desde el Este pasando por el Oeste y continuando al Suroeste del casco urbano. De lo manifestado por el recurrente ante en relación aumento del caudal del cuerpo de aguas que discurre sobre lo que el recurrente llama “poza de agua” debido a la supuesta aprobación por parte de la Municipalidad aquí recurrida en la ampliación de la Ruta Uno.

Esta administración municipal desde la alcaldía procede a dar respuesta de los extremos dichos por el recurrente, así como procedemos a demostrar que este no lleva la razón, por cuanto el cuerpo de aguas que este menciona existe desde mucho más atrás de los años setenta, dicho cuerpo de agua nace al Este del casco urbano continua atravesando el casco urbano en busca del suroeste pasando por los barrios que vienen en línea desde el Este, Oeste (Dirección04 y San Martin) desfogando en las fincas ubicadas al Suroeste uniéndose con la quebrada Florentina. la hoja cartográfica de Costa Rica 067 Cañas escala 1:50000 del Instituto Geográfico Nacional (IGN) se evidencia la presencia de un cuerpo de agua, que inicia en el sector este de la ruta 1, cruza esta ruta continuando hacia el oeste, pasando por barrio San Martín y siguiendo su curso hacia el suroeste por aproximadamente 4 km hasta confluir con la Quebrada Florentina (ver detalle en imagen C-03).

Consta en la información geoespacial que tiene disponible la que la Dirección de Aguas en el visor público de la plataforma SINIGIRH, que al Oeste de Dirección01 se ubica una quebrada sin nombre que es afluente de la Quebrada Poza de Agua. En imágenes satelitales con referencia C-1 y C-02, correspondiente a la imagen satelital de los años 2007 y 2017 respectivamente, se muestra el rastro de un cuerpo de agua. En imagen C-04, el Departamento de Catastro de la Municipalidad de Cañas, realiza un montaje de planos catastrados que colindan con la acequia que va desde la Dirección05 atravesando Barrio San Martín hasta desfogar en quebrada sin nombre afluente de quebrada poza de agua. Se adjuntan algunos planos de catastro de referencia donde se muestra la acequia, identificados en la imagen C-04 en color rojo. Del uso dispuesto por la normativa vigente para las acequias, quebradas ríos como desfogue de las aguas pluviales (competencia de las Municipalidades gestionar) se establecen las siguientes: 1- De conformidad con el artículo 121 del Reglamento de Construcciones del INVU, las aguas pluviales de las edificaciones deben descargarse a sistemas de alcantarillado pluvial, a cauces naturales o pueden ser reutilizadas, siempre que no sea para consumo humano.

De manera similar, el Reglamento de Fraccionamientos y Urbanizaciones del INVU, en su artículo 42 señala “…En todo proyecto de urbanización las aguas pluviales deben ser conducidas hacia un sistema de alcantarillado pluvial, que garantice por medio de tuberías, conductos y demás obras accesorias, el vertido de las aguas de lluvia hacia lugares naturales de disposición.” Por lo que no existe un impedimento para que se realice la descarga de aguas pluviales en cauces naturales. De lo manifestado por el recurrente ante la supuesta falta de controles y cumplimiento de la normativa que regulan las condiciones urbanísticas que deben de reunir las aguas pluviales residuales en la zona oeste del Casco urbano (Dirección04 y San Martín). Como administración activa local competente en regular y vigilar el crecimiento urbano, procedemos a demostrar que el recurrente en sus alegatos no lleva la razón, por cuanto el Departamento de Desarrollo y Control Urbano la Municipalidad, como parte del proceso para la aprobación de permisos de construcción, los funcionarios revisan en los planos constructivos que efectivamente las aguas residuales de las edificaciones se descarguen a un sistema de tratamiento (ya sea tanque séptico o planta de tratamiento), y no al sistema de alcantarillado pluvial.

De igual forma, durante el proceso constructivo se realizan inspecciones de avance y en los casos en que se detecta alguna modificación se informa al Ministerio de Salud, para que proceda según sus competencias. Por otro lado, el Reglamento de Construcciones del INVU, en su artículo 118 indica que “las aguas residuales deben de ser tratadas y dispuestas en un alcantarillado sanitario, tanque séptico o un sistema de tratamiento que cumpla con lo dispuesto en el Reglamento de Aprobación de Sistemas de Tratamientos de Aguas Residuales, Decreto Ejecutivo N°39887- SMINAE y sus reformas o normativa que lo sustituya. Se prohíbe descargar las aguas residuales al sistema de alcantarillado pluviales…”. Análogamente, el decreto 42075-S-MINAE señala en su artículo 37 que “No se permite la descarga del efluente de los tanques sépticos a un cuerpo de agua, alcantarillado pluvial o cualquier otro elemento que no conduzca a un drenaje o a una unidad de tratamiento adicional antes de su descarga final.

No se permiten rebalses de aguas residuales del sistema de los drenajes.” Y como estamos ante un tema que se mezcla con la responsabilidad de las competencias de otras Instituciones del Estado, es importante resaltar en el tema de las aguas residuales con el decreto 42075-S-MINAE, mismo que remarca la responsabilidad en el tema de aguas residuales al propietario y profesional responsable en su artículo 12, al indicar que “el propietario del inmueble y el profesional responsable serán corresponsables del diseño y funcionamiento del sistema de tratamiento previo y del sistema de drenajes, sea este tanque séptico o planta de tratamiento de las aguas residuales. Cualquier cambio en el diseño de la planta de tratamiento, tanque séptico o sistema de drenajes deben estar expresamente autorizados por el Ministerio de Salud antes de que se inicien los trabajos de construcción”. Informe detallado de las acciones realizadas por el Departamento de Gestión Ambiental en el mantenimiento de limpieza dentro de la quebrada “Poza de Agua” entro del sector de Barrio San Martín. 1- Durante el año 2021, se realizaron trabajos de limpieza en los alrededores y dentro de la quebrada “Poza de Agua” en el paso por el barrio San Martín, estos trabajos de limpieza es importante resaltar que fueron siempre en resguardo de la normativa vigente en lo atinente a la protección de las quebradas y ríos así como nacientes y enfocando el trabajo en la eliminación del estancamiento de aguas en el sitio (dentro de la quebrada “poza de Agua”) realizando labores de movimiento (de manera manual) de sedimentos, piedras arbustos y algunos residuos no valorizables, mismos que obstruían el paso del agua sobre todo en época del verano que hay menos caudal en la quebrada “Poza de Agua” produciendo un estancamiento de las aguas pluviales ( producto de las lluvias repentinas e intermitentes que se dan al Este en las montañas) que corren de manera natural por el cauce de la quebrada, quedando estas aguas estancadas al paso de Barrio San Martín. 2- Es importante destacar que dentro de las labores de limpieza no se tocaron taludes colindantes con propiedades que produjeran un ensanchamiento del cauce natural de la quebrada “Poza de Agua”.

Informe detallado de las acciones realizadas por el Departamento de Unidad Técnica de Gestión Vial en el mantenimiento de la vía cantonal ajustado a la legislación vigente, a altura del paso de la quebrada “Poza de Agua” entro del sector de Dirección01. 1. Como parte del ejercicio económico del año 2021, específicamente del presupuesto extraordinario, se destinaron recursos para la creación del proyecto denominado “Rehabilitación De Paso De Alcantarilla Existente Sobre Quebrada En Dirección06° En Barrio Unión De La Ciudad De Cañas”, en las coordenadas 10°25¨37” Nombre01 85°06¨06” W (ver Ilustración N°1 del informe OFC-DIV-049-22) 2. Posterior a la aprobación de los recursos se realizaron visitas a campo y estudios preliminares para determinar el tipo de intervención a ejecutar, observando que la problemática en el sitio se da principalmente a que la estructura existente (cabezales), de acuerdo a los niveles genera erosión en la superficie de ruedo lo cual hace que exista únicamente un carril vehicular y dado a la no existencia de un puente peatonal, las personas deben de movilizarse sobre el calle, lo cual genera peligrosidad a los usuarios.

(Ver Ilustraciones N° 2 y N°3). 3. Importante mencionar que todos los trabajos se deben de construir sobre el derecho de vía y que los mismos serán para la conducción de aguas pluviales, aunque en sitio ya exista el flujo de otro tipo de aguas. (Ver Ilustraciones N° 4 y N°5 OFC-DIV-049-22). 4. Dado a la necesidad existente y con los recursos aprobados se inicia el proceso licitatorio de la obra mediante Licitación Abreviada 2021LA-00009-01 denominada Construcción de cabezales sencillos, cabezales con aletones, muretes, losas y otras obras en pasos de alcantarilla en caminos del cantón, de cual se genera la orden de Compra N°19284 y el contrato 014-2021. 5. A inicios de febrero del año 2022 se gira la orden de inicio de los trabajos, del cual se obtiene como resultado la ampliación de la calzada a 2 carriles vehiculares y adicionalmente la construcción de un puente en voladizo para dar continuidad a las aceras peatonales, garantizando la seguridad de los usuarios.

Todo esto sin realizar modificaciones o alteraciones a la ya existente quebrada “Poza de Agua” así como tampoco se está recargando el canal de desfogue con más agua, siendo lo real que únicamente se están mejorando las condiciones de tránsito tanto vehicular, así como peatonal principalmente, de este punto en específico, siendo la competencia a la que esta llamada la Municipalidad. (Ver Ilustraciones N° 6 y N°7 OFC-DIV- 049-22)”.

4. Por resolución de las 07:24 horas del 22 de agosto de 2022, la Magistrada Instructora le confirió audiencia al Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados.

5. Informa bajo juramento Nombre05, en su condición de Sub Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, en los siguientes términos:

PRIMERO: Con fundamento en el informe GSP-RCHO-2022-02688 de la Región Chorotega del AyA se indica: “..En referencia a la situación técnica de servicio de recolección y tratamiento del lugar de los hechos y sectores adicionales, se indica que efectivamente no se puede conectar servicios adicionales al alcantarillado sanitario existente en Cañas, porque alcanzaron el límite de capacidad de conexiones a la Planta de Tratamiento de Aguas Residuales y de tratamiento, y ante la dimensión del proyecto que se requiere, no se cuenta con los recursos necesarios para su formulación, diseño, ampliación o construcción, operación y mantenimiento. Que el sitio del denunciante está fuera de la cobertura actual de AyA, y lo acotado es ajeno a la competencia nuestra. La siguiente imagen muestra la ubicación de los Barrios Unión y San Martín y la red de alcantarillado sanitario… Sobre los hechos y alegatos aportados en ambos recursos de amparo, es preciso indicar que efectivamente AyA tiene conocimiento de la problemática existente en torno a las necesidades de saneamiento de las aguas residuales generadas en varios sectores del Cantón de Cañas, que no forman parte del área de cobertura de nuestra Institución, ya que del cien por ciento de los servicios de agua potable que conforma el Sistema de Agua Potable de Cañas, sólo se tiene un 25% de cobertura en redes de agua residual.

En ese sentido, AyA en ejercicio de su rol de Rectoría ha participado de diferentes sesiones de trabajo convocadas bajo la figura de la Comisión de Aguas Residuales de Cañas, donde se ha abordado los casos puntuales de los barrios que generan la problemática que aquí nos ocupa, brindado a esta comisión, en estricto ejercicio de las competencias y responsabilidades asignadas por mandato de Ley, asesoría técnica para la búsqueda de una solución definitiva para el saneamiento de las aguas residuales del Cantón de Cañas. Es importante reiterar a la honorable Sala IV que los barrios que nos ocupan se encuentran fuera del área de cobertura de los servicios brindados por AyA, y por tanto no cuentan con el aval institucional para la solución de saneamiento elegida en los proyectos de desarrollo urbanístico que dieron origen a los Barrios Unión y San Martín, Pedregal y Bello Horizonte. Asimismo, es necesario reiterar que, por mandato de ley AyA en los sistemas que se encuentran dentro de su área de cobertura, garantiza el servicio hasta donde legal y técnicamente le sea factible, siempre y cuando se cumpla con la totalidad de los requerimientos que se han establecido para esos efectos.

Además, resulta oportuno mencionar que Costa Rica ha reconocido a nivel constitucional el derecho de contar con una vivienda digna, así como el derecho a la educación y la salud. No obstante lo anterior, es importante que la honorable Sala Constitucional tome en cuenta que todas las condiciones de las personas que habitan en estos barrios en cuestión, y que han sido señaladas por el recurrente, no le acreditan para omitir el cumplimiento de todos los requisitos establecidos por Ley para el desarrollo de proyectos de desarrollo inmobiliario, más bien pareciera que lo que se busca es valerse de su condición y así conseguir el aval de Instituciones como las aquí involucradas, para consolidar el levantamiento de caseríos que han sido construidos, al parecer, sin la observancia de la norma constructiva costarricense, poniendo en peligro la integridad física y la salud de las personas que las habitan.

Es vital que la honorable Sala IV, considere que la Ley de Salud Pública No. 5395 dispone lo siguiente: Artículo 308.- Sin perjuicio de las facultades de otras autoridades o entidades competentes en la materia, toda persona que se ocupe de la urbanización de terrenos y de la construcción de edificios para la vivienda, deberá cumplir las disposiciones de las normas sanitarias que sobre la materia dicte el Ministerio en resguardo de la salud de las personas. Artículo 310.- Queda prohibida la construcción de viviendas en nuevas urbanizaciones o loteos de predios mayores cuyos servicios y sistemas sanitarios no cumplan con las disposiciones legales y reglamentos vigentes. Artículo 311.- Las mismas reglas establecidas en los artículos anteriores, se aplicarán a la formación de nuevas ciudades o poblaciones Artículo 313.- Toda vivienda individual, familiar o multifamiliar, deberá cumplir con los siguientes requisitos sanitarios: .(…) 8.

Medios de saneamiento básico: a) Abastecimiento continuo de agua potable, en cantidad y presión suficientes, accesibles a todos los ocupantes. b) Sistemas adecuados de eliminación de excretas, de aguas negras, servidas y pluviales aprobados por la autoridad de salud. c) Artefactos sanitarios primarios mínimos.” (subrayado es propio) Entonces, resultaría temerario para la seguridad jurídica de nuestro país, el permitir situaciones como las que aquí nos ocupa, ya que al parecer se está procurando –a través de la figura del recurso de amparo y de la embestidura de la honorable Sala Constitucional-acreditar el acceso de servicios básicos (mediante una fuente pública o cualquier otro medio) a una finca en la que se han desarrollado viviendas o caseríos sin el debido proceso en materia constructiva, y por tanto sin cumplir los requisitos establecidos por Ley; lo cual a la postre más bien incrementa el riesgo de la salud de las personas que habitan tales viviendas, tanto desde la perspectiva de la inseguridad que representa habitar una vivienda que se levantó sin contemplar el Código Constructivo de Costa Rica, así como habilitarla sin verificar la forma en la que se disponen sus aguas residuales.

Se reitera de forma respetuosa que en caso de comprobarse que un determinado inmueble no cuenta con un sistema adecuado de disposición de sus aguas residuales por causas ajenas a la voluntad Institucional, no debería comprometer a una institución como la nuestra a ofrecer un servicio para personas que habitan sectores fuera de la cobertura de nuestros sistemas, sin que exista factibilidad técnica y legal para la prestación de los servicios. A la luz de los argumentos presentados se puede reiterar que los proyectos San Martin, La Unión, Pedregal y Bello Horizonte no cuentan con disponibilidad de recolección y tratamiento, para lo cual fueron desarrollados con otras alternativas de saneamiento reguladas por la Municipalidad a efectos de asegurar una adecuada construcción de los sistemas (disposición y tratamiento individuales), y un control conforme a la Ley General de Salud. (…) Para dar respuesta al caso de Dirección02 se requiere exponer un recuento de datos tanto histórico cómo técnico de la siguiente manera: 1.

El Alcantarillado Sanitario de Cañas data de los años 60´s del siglo pasado y las lagunas de Cañas, específicamente la Laguna San Cristobal, mencionada en literatura desde el año 1958. 2. La cobertura del Alcantarillado Sanitario es una parte del distrito central de Cañas, no lo es de toda el área donde se da el servicio de agua potable. Esto significa que sólo un pequeño porcentaje de la población goza de este beneficio. (Figura No.2. Cobertura de Agua Potable, en Azul, cobertura de agua residual en amarillo, Dirección07 en rojo.). 3. El Alcantarillado Sanitario, es mixto. Que significa, que tanto las aguas residuales como las aguas de lluvia; estas últimas que no son competencia institucional, sino propia de la municipalidad, van en una misma tubería. Este es el único alcantarillado sanitario en el país bajo esta modalidad, Cañas fue el ejemplo de que no se debe hacer, pues en este país de tipo tropical con intensidades de lluvia muy altas, y con el cambio climático, a quedado sobre su capacidad de diseño hace muchísimos años. 4.

Los tanques sépticos, que es el resto del área que se muestra fuera del área de cobertura de Alcantarillado Sanitario, corresponde en primera instancia al Ministerio de Salud y segundo a la Municipalidad de Cañas. Una vez establecidas estas premisas y como han afectado lo técnico, y el crecimiento de Cañas, es importante esclarecer por qué no se ha permitido más conexiones que no sean las de crecimiento vegetativo. De la figura No.2. se puede ver qué técnicamente era imposible desde la concepción del Alcantarillado Sanitario, conectar dicho barrio por la parte aguas que significa la ruta nacional, es evidente que las aguas escurrirán al lugar más bajo, que en este caso es las lagunas y más allá el Dirección02. Así que, tanto por niveles, como por capacidad de las lagunas, no puede interconectarse. Respecto del segundo punto, es importante indicar que la Municipalidad de Cañas, por más de cincuenta años, ha tenido la oportunidad de crear la conceptualización de un Alcantarillado Pluvial, de construirlo y con ello no sólo aportar a la mejor condición de vida del cantón de Cañas, sino en disminuir la contaminación presente en dicha ciudad.

La apertura de la quebrada técnicamente corresponde a la creación de un canal para que las aguas de lluvia discurran hacia cauce. Sin embargo, al no funcionar los tanques sépticos de Dirección02, que como bien dice el recurso de amparo es el generador de ordenes sanitarias, por bypaseo de tanques sépticos hacia la calle, las aguas pluviales se mezclan con aguas residuales y se incrementa la contaminación del cauce abierto por dicha municipalidad y convirtiéndose en un problema serio de salud pública, por olores, por vectores y por lo indicado en el artículo 50 de nuestra constitución política, donde todos tenemos derecho a un ambiente limpio, sostenible y sin contaminación como lo que sucede actualmente. Se aclara que el origen de este problema y en fin del recurso de marras, es la conexión irregular de aguas residuales al alcantarillado pluvial o bien su desvío a cordones y caños, lo que por pendiente y efecto de la gravedad viene a llegar al canal sobre el que los vecinos citan la problemática de apertura de un canal por parte de la Municipalidad de Cañas.

No sólo esta comunidad dentro de Cañas sufre de estos problemas, cerca del centro del cantón se pueden citar a Bello Horizonte, La gran Piedra y Pedregal que se quejan de los suelos que no filtran. Ellas no tienen solución de Alcantarillado Sanitario por estar fuera del área de cobertura, lo que igualmente al tener problemas con su tanque séptico y drenajes, desvían sus aguas a cordón y caño. En ese sentido el Ministerio de Salud durante las reuniones han expuesto el caso al AyA para que se mejore el alcantarillado sanitario y los valores de la calidad del agua residual de la PTAR de Cañas, sin embargo, sin primero una separación de alcantarillados y un estudio y diseño de lo que hay en materia de Saneamiento, no puede ser posible. A continuación, se muestra una serie de fotografías que se tomaron en marzo anterior, sobre un trabajo realizado por la Municipalidad de Cañas que se muestra en las imágenes siguientes.

Debe señalarse, que la apertura de cauces debe realizarse con los consabidos estudios técnicos, para evitar el derrumbe de taludes y posibles afectaciones a terceros. Las fotografías mostradas son de marzo, por lo que toda el agua ahí empozada es agua residual. Respecto a la problemática de capacidad del sistema de tratamiento: Una primera parte del problema localizado es lo indicado por la infiltración de agua de lluvia, que no sólo aumenta la velocidad hidráulica en el sistema lagunar, sino porque reduce el tiempo de retención lagunar y recolecta aguas que traen químicos entre otros que no puede procesar el sistema facultativo que se tiene instalado. Aparte de lo anterior y como una segunda razón de que el sistema no cumpla con todos los parámetros de ley, es que las lagunas han venido funcionando desde hace más de cincuenta años y continúan haciéndolo con eficiencias razonables, pero las cantidades de conexiones aumentan, las cargas aumentan y el sistema no ha cambiado desde entonces.

Son los aportes a nivel operativo y de mantenimiento los que han hecho que las lagunas sigan en funcionamiento. Por otra parte, es la Sub-Gerencia Operativa, la encargada de elevar la problemática de Cañas a la Administración superior; sin embargo, desde el marco de la Comisión de Aguas Residuales de Cañas, de la que forma parte la Región Chorotega en la persona de la Ing. González Palma; es que se ha formulado para las altas autoridades del Ministerio de Salud, de la Presidencia Ejecutiva, así como de la Asamblea Legislativa a fin que todos los interesados supieran la problemática desde el punto de vista de los que operan y no poseen los mecanismos para la toma de decisiones respecto de proyectos de gran envergadura. Como una primera instancia, se hace imprescindible que se separen los Alcantarillados, pues ciertamente al momento de presentarse una lluvia, el aporte de esta agua hacia el sistema de tratamiento, posteriormente se deben valorar otras opciones para los barrios afectados, pero debe indicarse que esto es una problemática generada por la corporación municipal, que desde hace muchos años giró permisos de construcción sin que se realizaran obras de alcantarillado pluvial, y a sabiendas de la problemática de los suelos en Cañas.

Igualmente, el AyA, es Ente Rector en saneamiento, pero no tiene la potestad de aprobar o desaprobar el funcionamiento de tanques sépticos o bien su emplazamiento. Asimismo, los administrados existentes que primera oportunidad se conectaron al sistema sanitario sin que se generara dicha problemática, son a los cuales de forma primaria se les debe asegurar el servicio, dado que las condiciones hacían posible esa conexión, debe tenerse presente que no se puede ampliar algo a sabiendas que se trasladará un problema de un sector de Cañas a otro, la solución debe ser integral, y requiere que primero se quite del sistema sanitario todo el caudal pluvial. Ciertamente al momento de construir la carretera, el sistema de aguas pluviales de dicha ruta desfoga en nuestro alcantarillado, lo que vino ya de por sí a agravar una situación que era delicada en su momento. Recomendaciones Técnicas del Informe: 1.

Corroborar que el cauce abierto es una quebrada como tal. En caso que no lo sea, la apertura de la misma no debió de darse. 2. En caso de que así sea, asegurar los márgenes de este cauce. El mismo no puede verter a una propiedad, sino debe correr a cuerpo receptor. 3. Separación del Alcantarillado Pluvial por parte de la Municipalidad, para lo cual ejercerá sus mejores prácticas para poder planificar en un mediano plazo la consecución de recursos para este fin. 4. Girar las órdenes sanitarias respectivas, para que la comunidad de San Martín y otros barrios desconecten sus aguas residuales y no las viertan a la calle, que, en aquellos casos de utilización de tanque séptico, dicho sistema se utilice debidamente y se le dé el mantenimiento correspondiente. 5. Ya se elevó a la Administración superior por parte de la Región Chorotega- AyA, la necesidad de aumentar la capacidad de tratamiento de la PTAR Cañas y la extensión de sus redes colectoras.

Esta petición consta en el informe indicado por la Señora ministra de Salud. Desde una perspectiva técnica que el AyA ha interpuesto sus buenos oficios, en mantener aquello que en materia de competencias le corresponde, en los diversos foros como lo son la Comisión de Aguas Residuales ha indicado lo que sería una ruta de acción a seguir para mejorar la problemática, pero al ser un problema de muchos años, de mucha inversión y que es atinente en todo sentido a otras instituciones, no puede ser solamente atendido por la Institución…” SEGUNDO: Al no haberse construido adecuadamente los tanques sépticos y no habérsele dado el debido mantenimiento debido, los vecinos encontraron como solución desfogar a la quebrada existente, situación que se acrecentó con la realización de la Ruta. Se explica que, debido a la ampliación de la Ruta Interamericana Uno, el referido cuerpo de agua sufrió modificaciones en su cauce natural, específicamente en el sector Oeste.

De forma correcta tal y como indican los recurrentes: la Municipalidad de Cañas permitió el desfogue de las aguas pluviales, residuales y negras de las viviendas, hacia dicho cuerpo de agua. Se reitera que no existe alcantarillado sanitario en uso y previsto en dicho residencial, dado que por estar localizado geográficamente en una posición inferior, no tiene posibilidad de conexión a la red existente, por lo que los vecinos propietarios deben utilizar tanque séptico hasta el momento en que sea posible materialmente realizar una solución de alcantarillado sanitario, mediante una estación de bombeo que traslade las aguas residuales al sistema actual. El problema que enfrentan los recurrentes se da por la mala práctica de los propios vecinos en este caso dentro del Dirección02, de no haber construido adecuadamente sus tanque sépticos, no darle mantenimiento como debería de ser, creando sus propios vecinos el foco de contaminación que aqueja a los recurrentes, descargando las aguas tanto pluviales como residuales a un cuerpo de agua (sin contar con la autorización correspondiente del MINAE y por beneplácito del mismo Gobierno Local).

Por estar el problema dentro de propiedad privada (tanques sépticos) y donde el AyA no puede interferir, ya que se encuentra dentro del ámbito de lo privado y le corresponde al MINISTERIO DE SALUD, dadas sus competencias por ley, ordenar a los propietarios del Barrio San Martín, detener de forma inmediata la contaminación que se encuentran ejerciendo. Los desarrolladores tienen la mala práctica de construir sus desarrollos con tanque séptico, sin tener conocimiento si el terreno donde desarrollan reúne las condiciones de infiltración y geológicas para poder utilizar los tanques sépticos, ya que es un sistema más económico que una planta de tratamiento de aguas residuales, así mismo dejan una tubería enterrada, la cual no llega a ningún colector o subcolector del AyA, es simplemente un tubo que dejan los desarrolladores en el tiempo con el fin de que cuando el AyA, pase cerca con sus tuberías de aguas residuales puedan conectar a sus desarrollos a la red del AyA, pero esto lo hacen sin la aprobación del AyA, como ya se mencionó el Barrio San Martín nunca vino al AyA, para analizar ninguna de sus etapas.

El MINISTERIO DE SALUD, conforme con sus competencias ha girado las ordenes sanitarias a todos los vecinos de Barrio San Martín poner a funcionar adecuadamente sus tanques sépticos, actividad que debe materializarse mientras se logra construir el Proyecto de Alcantarillado Sanitario.. Los sistemas de tanque séptico, se constituyen en una tecnología alternativa a las redes de recolección tradicionales, las cuales son utilizadas a nivel nacional y a nivel mundial, como una opción idónea para el adecuado tratamiento y disposición de las aguas residuales, sobre todo en aquellos lugares donde no existe infraestructura sanitaria o por topografía del terreno no es factible su interconexión a los colectores administrados por el AyA, como es el caso de los recurrentes. En Costa Rica un 70% de las aguas residuales son dispuestas y tratadas mediante la tecnología del sistema de tanques sépticos y deben los propietarios brindarle el mantenimiento adecuado, y no construir sobre las zonas de absorción y aireación del drenaje.

Los tanques sépticos son una solución técnica al problema de las aguas residuales, siempre y cuando se construya de acuerdo con el diseño y a las características de cada suelo. En el caso de las aguas residuales domésticas, el tanque séptico debe recibir las aguas provenientes del fregadero de la cocina, de las pilas de lavar ropa, de la lavadora, de las duchas, de los lavatorios y de los servicios sanitarios. Es importante recalcar, que todas las aguas residuales que generamos deben ser recolectadas en una tubería especial, dentro de la vivienda y disponerlas en el tanque séptico. Un tanque séptico bien construido y diseñado con un sistema de drenaje adecuado y dependiendo del número de personas que vivan en la vivienda, requiere de una limpieza cada 6 meses o cada año, para eliminar los lodos que se han sedimentado y acumulado en el fondo del tanque. Los recurrentes vieron más fácil al no contar un funcionamiento adecuado de tanque séptico disponer todas las aguas a un cuerpo de agua y solicitarle a la Sala Constitucional que le ordene al AyA, que los conecte a algún sistema de aguas residuales del AyA, sin entrar a conocer o por ignorancia de que la solución no es esa en este momento, pues se requiere cumplir con una serie de etapas a nivel de diseño, presupuesto, planificación, contratación, para lograr materializar un Proyecto de Alcantarillado Sanitario.

Cuando cada uno de los vecinos compraron sus casas lo hicieron con un tanque séptico al cual tienen la obligación de darle mantenimiento cada 6 meses, son sus propios vecinos quienes están vertiendo aguas contaminadas al cuerpo de agua, contaminando el ambiente,. Sí los vecinos de Dirección02 hacen lo correcto, este recurso carece de fundamento, si cada vecino cuenta con un tanque séptico dentro de su propiedad y tiene conectadas las aguas provenientes del fregadero de la cocina, de las pilas de lavar ropa, de la lavadora, de las duchas, de los lavatorios y de los servicios sanitarios, y le da el adecuado mantenimiento no estaríamos teniendo este problema con las aguas residuales. Así mismo, están tratando de responsabilizar al Estado, de lo que sus vecinos han dejado de hacer por años, pretende que por medio de un Voto de la Sala Constitucional, se le traslade la responsabilidad al Estado costarricense y dejando a los vecinos impunes al ser ellos los responsables de la contaminación que están generando, evadiendo con este acto la responsabilidad que tenemos cada uno de los costarricenses con el medio ambiente y exponiendo a sus propias familias y vecinos a un problema de salud pública.

Con el fin de reducir el riesgo de salud pública que está generando los vecinos de los recurrentes, el MINISTERIO DE SALUD debe continuar de identificando los vecinos que se encuentren contaminando y girar las ordenes sanitaria correspondientes, con el fin de que estos conecten correctamente las aguas provenientes del fregadero de la cocina, de las pilas de lavar ropa, de la lavadora, de las duchas, de los lavatorios y servicios sanitarios al TANQUE SÉPTICO y evitar que siga descargando sus aguas residuales al cuerpo de agua existente, hasta que dentro de la posibilidad financiera, de contratación y construcción se materialice el Proyecto de Alcantarillado Sanitario, que beneficiará a Bello Horizonte, La Gran Piedra, Pedregal, La Corte, Los Malinches Barrio Chorotega, Las Palmas, El Bosquecito, San Antonio, Barrio Unión, San Martín, Las Cañas, Villa Esperanza, Miguel Araya, San Cristóbal Sur, Imas, y Barrio San Martín.

TERCERO: El AyA no puede invertir en los tanques sépticos que se ubican dentro de las propiedades de Dirección02, dado que nuestra institución se encuentra enmarcada dentro de la LEY DE LA ADMINISTRACIÓN FINANCIERA DE LA REPÚBLICA Y PRESUPUESTOS PÚBLICOS, No. 8131 de 18 de setiembre del 2001, Publicado en La Gaceta No. 198 de 16 de octubre del 2001. No podemos dejar de lado, que la aprobación del presupuesto determina la legalidad de los gastos públicos. Como norma jurídica, el presupuesto es la norma de la actividad financiera del gasto público para el año fiscal correspondiente, por lo que limita la actuación de los Poderes Públicos en el uso y disposición de los fondos públicos. De conformidad con el artículo 176 constitucional, el presupuesto se presenta como un acto de mera previsión o cálculo contable de los ingresos, mientras que respecto a los egresos públicos, mantiene el triple efecto: autorización del gasto, limitación de la cantidad a gastar, fijación del destino que haya de darse a los créditos aprobados en el presupuesto.

Lo anterior se deriva del Principio de Legalidad consagrado en el artículo 11 de la Constitución Política, y desarrollado también en el artículo 11 de la Ley General de la Administración Pública, que, como es sabido, el principio de legalidad en el estado de derecho postula una forma especial de vinculación de las autoridades e instituciones públicas al ordenamiento jurídico, a partir de su definición básica según la cual toda autoridad o institución pública lo es y solamente puede actuar en la medida en que se encuentre apoderada para hacerlo por el mismo ordenamiento, y normalmente a texto expreso –para las autoridades e instituciones públicas sólo está permitido lo que esté constitucional y legalmente autorizado en forma expresa, y todo lo que no les esté autorizado les está vedado–; así como sus dos corolarios más importantes, todavía dentro de un orden general; el principio de regulación mínima, que tiene especiales exigencias en materia procesal, y el de reserva de ley, que en este campo es casi absoluto." (Sala Constitucional.

Resolución Nº 440-98, y en sentido similar la Nº 5541-97 y 1739-92). Oficio 12956 el 24 de noviembre de 2003 (DAGJ-1719-2003). Lo anterior debe cumplirse por mandato legal y que los propietarios utilicen y den mantenimiento a los tanques sépticos hasta que se logre materializar el Proyecto de Alcantarillado Sanitario a cargo del AyA y el Alcantarillado Pluvial a cargo de la Municipalidad. CUARTO De conformidad con el artículo 169 de la Constitución Política la Municipalidad debe velar por los intereses de todos los habitantes del Cantón, por ello el artículo 50 de la Constitución Política obliga a las Municipalidades a garantizar el mayor bienestar de los ciudadanos del Cantón, estimulando el desarrollo hacia una justa distribución de la riqueza con un ambiente sano ecológicamente equilibrado y por ello el artículo 11 de la Constitución obliga a esa Municipalidad y a sus funcionarios a someterse a la rendición de cuentas y evaluación de los resultados, lo que implica al tenor del artículo 129 de nuestra Constitución Política.

El artículo 169 de la Constitución Política y el Código Municipal, indican que la MUNICIPALIDAD, es el Ente Territorial que debe garantizar el cumplimiento de las obligaciones por los intereses locales en forma originaria y primaria, que debe instrumentalizar las acciones necesarias para el desarrollo de las actividades en su cantón, siendo de su competencia exclusiva. QUINTO: Tal y como consta en la prueba del expediente mediante acta del 24 de junio 2022, CTAR-CÑ-0001-2022, se indicó por parte del Instituto: “…..2 A nivel de Acueductos y Alcantarillados (AyA) tanto desde lo local como lo regional, no cuenta con los recursos económicos para el diseño, ampliación y construcción de un nuevo alcantarillado sanitario en Cañas y sugiere, entre otras cosas, la "separación del Alcantarillado Pluvial por parte de la Municipalidad, quien deberá planificar en un mediano plazo la consecución de recursos para este fin".

Asimismo, recomienda "elevar a la Administración superior por parte de la Región Chorotega- AyA, la necesidad de aumentar la capacidad de tratamiento de la PTAR Cañas y la extensión de sus redes colectoras", así como "realizar un informe en conjunto a fin de elevar a las diversas autoridades la problemática existente en Cañas". Lo anterior en vista de que existen muchos barrios aledaños al casco central de la ciudad, que no cuentan con alcantarillado sanitario y tienen problemas de aguas residuales que generan denuncias constantemente y hasta recursos de amparo. 3. Del mismo modo, AyA informa que: "a abril de 2022 existen activos 7214 servicios de agua potable, en cuanto a la prestación del servicio de alcantarillado sanitario y tratamiento de aguas residuales y excretas actualmente tiene una cobertura de aproximadamente del 24.54%. El restante 75,46% cuenta con servicios de saneamiento como tanques o fosas sépticas, letrinas o no poseen cobertura alguna" y "según el sistema comercial DATAMART2, la cobertura de agua potable y alcantarillado sanitario según tipo de tarifa se detalla de la siguiente manera: (…) 6.

Si bien la normativa vigente facilita herramientas legales, como el artículo 12 del Decreto N° 42075- S-MINAE, donde se delega responsabilidad tanto al propietario del inmueble como al profesional responsable de la obra sobre el diseño, funcionamiento y cambios del sistema de tratamiento de aguas residuales; no obstante, la problemática de Cañas abarca construcciones de larga data, por lo cual resulta materialmente imposible la aplicación de este artículo sin generar un perjuicio a quienes habitan esas viviendas, porque los actos administrativos que puedan aplicar las instituciones son dirigidos a los dueños de las propiedades y no a! profesional responsable de la obra. 7. Otro factor que resulta importante mencionar es que la recomendación de separar el alcantarillado pluvial del alcantarillado sanitario existente no asegura que el problema de fondo sea resuelto, dado que la problemática trasciende áreas geográficas que no están conectadas a esta red.

Además, resolver esta problemática es materialmente imposible de solventar tanto para AyA, RCH como para la Municipalidad de Cañas, por lo cual es requerido la formulación de un proyecto con presupuesto asignado desde el nivel central que ayude tanto a la municipalidad como al AyA a la ejecución de este. 8. Tal y como se mencionó en el primer apartado de este acuerdo, esta problemática es evidente, mas no excluyente, en el distrito primero del cantón de Cañas, con mayor afectación en los siguientes sectores: Bello Horizonte, La Gran Piedra, Pedregal, La Corte, Los Malinches Barrio Chorotega, Las Palmas, El Bosquecito, San Antonio, Barrio Unión, San Martín, Las Cañas, Villa Esperanza, Miguel Araya, San Cristóbal Sur, Imas…” El sistema Pluvial debe generarse e independizarse bajo responsabilidad del Gobierno Local, del actual alcantarillado Sanitario, dado que el Alcantarillado Sanitario no está diseñado para recibir caudales pluviales, situación que el Gobierno Local ha favorecido al permitir este tipo de conexiones al sistema sanitario existente, generando que ante eventos naturales de caudal de lluvia, se supere la capacidad existente de la tubería sanitaria y por consiguiente afectando la Planta de Tratamiento.

SEXTO: El estado actual del Proyecto de Alcantarillado Sanitario Cañas-Guanacaste, se indica con fundamento en el informe SB-AID-2022-00381 de la Subgerencia de Ambiente Investigación y Desarrollo. “…el documento CTAR-CÑ-001- 2022, en donde se cita: A raíz de esto, la Presidencia Ejecutiva requirió la participación de la Dirección Diseño de Saneamiento de la UEN Programación y Control en la última sesión de la comisión interinstitucional, sostenida el pasado 4 de agosto, en donde se acordó plantear una hoja de ruta para la atención de la problemática en Cañas, la cual involucra el sistema de alcantarillado mixto (aguas residuales y pluviales). Como parte de los aspectos que se estarán valorando en esta hoja de ruta se tendrá lo siguiente: Estrategia de atención Con la finalidad de abordar la problemática mencionada y conociendo las posibles implicaciones técnicas, económicas y ambientales de esta situación, se ha planteará la siguiente hoja de ruta: 1.

Definir estudios básicos por desarrollar para el diagnóstico de la condición actual. 2. Establecer los estudios específicos para la conformación de la factibilidad del proyecto, considerando sus dos aristas: alcantarillado sanitario y alcantarillado pluvial. 3. Formular las acciones necesarias para la contratación de la factibilidad y los diseños preliminares requeridos. 4. Especificar labores mínimas necesarias para la contratación del diseño detallado de las obras de alcantarillado sanitario y alcantarillado pluvial. 5. Establecer tareas paralelas que permitan la viabilidad del proyecto: a. Adquisición de terrenos b. Constitución de servidumbres c. Estudios adicionales d. Permisos e. Viabilidad ambiental 6. Plantear la necesidad de gestionar el financiamiento para cada una de las fases supra citadas. 7. Proponer responsables de cada fase o sub-fase según obra por ejecutar. 8. Generar una propuesta conjunta de los costos estimados de cada macro tarea y el plazo correspondiente para su planificación y ejecución, considerando la experiencia previa de procesos similares.

Al ser este un proyecto integral y de gran complejidad técnica, se trabaja en una propuesta base, la cual estará fortaleciéndose con los aportes de cada institución, entendiendo que la solución deberá desarrollarse en forma paulatina y conforme a la disponibilidad de recursos financieros y técnicos de los que se disponga. Esta estrategia se deberá presentar a la Comisión cerca del 7 de setiembre, sin embargo, aún no se cuenta con los insumos completos. Cabe señalar que, en función de la aprobación de estrategia y la definición de plazos y responsables, se podrán establecer acciones en concreto, que permitan generar una programación tentativa del proyecto. Sin embargo, por el momento no es posible brindar una fecha de ejecución de las obras ni del inicio de su fase de pre-inversión. Finalmente, se aclara que la ejecución de estas actividades no corresponde exclusivamente a nuestra institución y deberán ser abordadas en conjunto con el Ministerio de Salud y la Municipalidad de Cañas…” ANÁLISIS DE FONDO: Conforme al artículo 1 de la Ley Constitutiva de AyA, el Instituto es el encargado de administrar y operar sistemas de acueducto y alcantarillado sanitario, sin embargo, en materia de alcantarillado pluvial el legislador mantuvo dicha competencia bajo la égida de los Gobiernos Locales salvo que se trate de rutas nacionales en cuyo caso la responsabilidad del pluvial recae en CONAVI, los cuales tienen entera responsabilidad de velar porque el alcantarillado pluvial funcione en condiciones adecuadas y acatar la normativa técnica que en la materia emita AyA, en virtud de que se ejerce rectoría en dicho campo, aun cuando la Sala Constitucional ya ha indicado reiteradamente que la autonomía municipal impide el ejercicio de competencias rectoras que provengan del Gobierno u otras entidades del sector público hacia los Gobiernos Locales, también ha considerado que en los casos en que se encuentra de por medio un problema de salud pública o ambiental se flexibiliza dicha autonomía de frente a un interés superior como los citados, de manera que se deberá acatar dicha normativa técnica.

En Costa Rica existen dos sistemas de alcantarillado separados, uno denominado “Sistema de Alcantarillado Pluvial” cuyo objetivo es transportar las aguas de lluvia provenientes de techos, canoas y bajantes de las viviendas, así como las aguas de lluvia que discurren por las vías públicas, y el otro sistema se denomina “Sistema de Alcantarillado Sanitario” cuyo objetivo es transportar únicamente las aguas residuales provenientes de pilas, fregaderos, duchas e inodoros que se generan a lo interno de las viviendas. De acuerdo con la reglamentación vigente, los sistemas de alcantarillado pluvial son administrados por las municipalidades de cada cantón y el sistema de alcantarillado sanitario es operado y mantenido por el operador a cargo de prestar el servicio de agua potable dentro de su respectiva área geográfica de cobertura. Por su parte, los Gobiernos Locales cuentan con la facultad de establecer una serie de limitaciones a construcciones y proyectos, mediante la planificación urbana, destacando que en caso de que se incumplan las condiciones que ordenen cuentan con una serie de mecanismos coercitivos para hacer cumplir sus mandatos, de los cuales carece AyA.

Aunado a lo anterior, se tiene claro que las Municipalidades son los entes que recaudan los montos respectivos para mantenimiento y buen funcionamiento de la Red Pluvial, tal y como lo dispone el Código Municipal No. 7794, en el Título IV. Hacienda Municipal, Capítulo II. Los ingresos municipales. En el presente caso, no se puede dejar de lado que las Municipalidades cuando cobran los impuestos municipales incluyen el rubro correspondiente al mantenimiento y operación de la red pluvial, lo que recalca la competencia municipal en este campo, además de que resulta evidente que este rubro debería ser utilizado en el mantenimiento y operación de la red pluvial de cada Municipalidad, como lo indica la Sala Constitucional en el Voto 2001-2320, en el Considerando IV, que a la letra dice: (…) Asimismo, la Ley General de Salud No. 5395, señala en sus artículos 285 y 292 lo siguiente: “ARTÍCULO 292.- Queda prohibido en todo caso la descarga de las aguas negras, de las aguas servidas y de residuos industriales al alcantarillado pluvial.

El Ministerio queda facultado para restringir, regular, o prohibir la eliminación de productos sintéticos no biodegradables a través de los sistemas de recolección de excretas, aguas negras y servidas. ARTÍCULO 285.- Las excretas, las aguas negras, las servidas y las pluviales, deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad.” En este mismo sentido señala el artículo 1 de la Ley de Construcciones N° 833, que: "Las Municipalidades de la República son las encargadas de que las ciudades y demás poblaciones reúnan las condiciones necesarias de seguridad, salubridad, comodidad y belleza en sus vías públicas y en los edificios y construcciones que en terrenos de estas se levanten sin perjuicio de las facultades que las leyes les concedan en estas materias a otros órganos administrativos".

Lo anterior evidencia la conexidad de las obligaciones municipales en materia de alcantarillado pluvial y la obligación señalada supra, las cuales se encuentran ligadas y bajo la administración de los Gobiernos Locales como parte de los servicios que se encuentran obligados a suministrar. De conformidad con el artículo 169 de la Constitución Política la Municipalidad debe velar por los intereses de todos los habitantes del Cantón, por ello el artículo 50 de la Constitución Política obliga a las Municipalidades a garantizar el mayor bienestar de los ciudadanos del Cantón, estimulando el desarrollo hacia una justa distribución de la riqueza con un ambiente sano ecológicamente equilibrado, así como en el artículo 11 de la Constitución obliga a esa Municipalidad y a sus funcionarios a someterse a la rendición de cuentas y evaluación de los resultados, lo que implica al tenor del artículo 129 de nuestra Constitución Política.

El artículo 169 de la Constitución Política y el Código Municipal, indican que la MUNICIPALIDAD, es el Ente Territorial que debe garantizar el cumplimiento de las obligaciones por los intereses locales en forma originaria y primaria, que debe instrumentalizar las acciones necesarias para el desarrollo de las actividades en su cantón, siendo de su competencia el alcantarillado pluvial, salvo el que corresponde a CONAVI por ubicarse en vías nacionales. De acuerdo con las consideraciones que anteceden, se debe reiterar que, el alcantarillado pluvial se encuentra bajo responsabilidad de la Municipalidad de Cañas. Se debe buscar una solución respecto al sistema de evacuación de aguas pluviales que al mismo tiempo libere el sistema de aguas negras, para que ambos funcionen de manera independiente y sin afectación o interferencia entre uno y otro. Recalcando que de acuerdo con lo que establece el Código Municipal en su artículo 83 es obligación del Gobierno Local, y; para ello cobra la tasa correspondiente, tanto la limpieza como el mantenimiento y adecuada operación de la red pluvial, que al colapsar por falta de mantenimiento puede afectar el saneamiento en general y la red sanitaria.

Efectivamente, la Municipalidad Cañas es la obligada a velar porque en su jurisdicción se cuente con un adecuado alcantarillado pluvial por ser un asunto de su competencia, pero con mayor razón es la responsable, de velar porque los terrenos en su jurisdicción, cumplan con la normativa vigente, de manera que predios vecinos no se vean afectados por la escorrentía o por la vulnerabilidad de sus terrenos, o peor aún, que por no contar con obras de estabilización o disposición de aguas pluviales, se altere la integridad física, material y ambiental de los predios circunvecinos. El AyA carece de injerencia directa en este tipo obras de alcantarillado pluvial, desde el punto de vista esencialmente jurídico, y partiendo del principio de legalidad, que es el que fija en la función pública el límite de sus actuaciones, los artículos 1 y 2 de la Ley Constitutiva de AyA, facultan al Instituto a girar normativa en materia de alcantarillado pluvial.

El artículo 60 de la Ley Orgánica del Ambiente establece, sobre la prevención y control de la contaminación(…) Con fundamento en los antecedentes legales, es responsabilidad de la Municipalidad de Cañas el alcantarillado pluvial y del Ministerio de Salud, como entes encargado de velar a través de inspecciones u ordenes sanitarias correspondientes, para el correcto funcionamiento y disposición de las aguas residuales, conexiones ilícitas al pluvial, de los vecinos de la comunidad hacia los sistemas correspondientes y así evitar un problema de contaminación. Mediante un manejo y disposición correcta de la basura, que no genere un taponamiento del sistema pluvial. Con base en las normas citadas, se concluye que la MUNICIPALIDAD DE CAÑAS, es la responsable directa en la determinación de las medidas requeridas para solucionar el problema de alcantarillado pluvial, esto sin perjuicio de que coordine con los entes que puedan gestionar para que ese alcantarillado sea el adecuado y velar igualmente porque los propietarios hagan uso adecuado del tanque séptico mientras se materializa una solución integral.

La MUNICIPALIDAD DE CAÑAS tiene la obligación de hacer cumplir las leyes en la materia y su obligación de garantizar el disfrute de los habitantes de la zona a un ambiente sano y ecológicamente equilibrado, con las consecuencias para la salud de esas personas debido a la naturaleza del problema sanitario que les aqueja. La Municipalidad teniendo pleno conocimiento de la problemática que afecta a los pobladores de su cantón, se ha limitado a constatar su existencia y evadir su responsabilidad y sin realizar las acciones oportunas para mitigar el mismo o controlarlo. La Municipalidad no ha verificado si todos los vecinos cuentan con tanque séptico y drenajes. El MINISTERIO DE SALUD, debe continuar apercibiendo a los vecinos del Dirección02, dándoles un plazo para que utilicen correctamente el tanque séptico, hagan las mejoras correspondientes, eliminen cualquier conexión clandestina que haya hacia redes previstas de aguas negras colocadas en la vía pública y ordenar a los vecinos a construir en el caso que se requiera ó habilitar el tanque séptico individual, con el respectivo drenaje dentro de su propiedad, este debe de tener las dimensiones necesarias, de manera que tengan la capacidad de recepción para no contaminar el ambiente. En caso del no cumplimiento de estas disposiciones y al vencimiento del plazo, se proceda a la declaratoria de inhabitabilidad de las viviendas para el desalojo.

6. En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Nombre06; y,

Considerando:

I.Objeto del recurso. La recurrente reclama la violación a sus derechos fundamentales, pues acusa que es una persona adulta mayor, vecino del Dirección01. Acota que en esa comunidad discurre parte de un cuerpo de agua que se identifica como Poza de Agua. Explica que, debido la ampliación de la Ruta Interamericana Uno, el referido pozo sufrió modificaciones en su cauce natural, específicamente en el sector Oeste. Acota que lo anterior, debido a que la Municipalidad de Cañas permitió el desfogue de las aguas pluviales, residuales y negras de las viviendas, hacia dicho cuerpo de agua. Reclama que la situación descrita, se ha dado por la negligencia de los servidores del municipio recurrido, al no ejercer el debido control y cumplimiento de la normativa que regula las condiciones urbanísticas que deben reunir las construcciones en general. Afirma que esa omisión no sólo produjo el vertido de aguas pluviales y residuales, sino también el de aguas negras en las tuberías colectoras que desembocan en el referido pozo.

Asimismo, alega que el ayuntamiento, con maquinaria municipal, realizó trabajos de ampliación del cauce de la quebrada, generando el abundante estancamiento de las aguas residuales. Sostiene que el ambiente se ha tornado insalubre y fétido, como consecuencia del vertido de aguas negras, lo que estimula el hábitat ideal para el desarrollo de mosquitos y toda variedad de insectos, situación que afecta tanto al Dirección02 como La Unión. Reitera que la situación que actualmente viven en sus comunidades es injusta, insostenible y grave dado que deben soportar el hedor y el peligro para su salud. Arguye que el problema expuesto los obliga a buscar protección de su derecho a la salud, producto de la negligencia del ente Municipal que ha permitido el desarrollo de viviendas sin el control y la supervisión que les compete, a fin de tomar acciones para resolver la problemática aludida. Por otro lado, comenta que el Ministerio de Salud tiene conocimiento de la situación expuesta, empero no ha realizado ninguna acción para solventarla. Añade que deben estar aplicando insecticidas en sus casas constantemente, con el alto costo económico que eso implica y con la afectación que provoca.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

  • a)Durante el año 2021, la Municipalidad de Cañas atendió solicitudes de parte de los vecinos de la comunidad de San Martín y Barrio Unión, para la limpieza de los alrededores de la Dirección02 (véase el informe).
  • b)El cuerpo de aguas que la recurrente menciona, existe desde mucho más atrás de los años setenta, dicho cuerpo de agua nace al Este del casco urbano continua atravesando el casco urbano en busca del suroeste pasando por los barrios que vienen en línea desde el Este, Oeste (Barrios La Unión y San Martin) desfogando en las fincas ubicadas al Suroeste uniéndose con la quebrada Florentina (véase el informe).
  • c)Consta en el expediente administrativo del Ministerio de Salud la denuncia No. 59-2021, interpuesta 12 de mayo del 2021, por los vecinos de Barrio San Martín contra La Municipalidad de Cañas, donde se indica “…el día 23 de setiembre del 2020, se interpuso denuncia ante el gobierno local acerca de la situación que vivimos los vecinos de la sequía que cruza del Barrio San Martín a Dirección03, 100m Sur del Super San Andrés las aguas se estancan en el cauce de esa quebrada, produciendo malos olores, roedores y zancudos, la misma se encuentra llena de basura y otros desechos, el agua ya no es clara, sino que es negra y de mal olor. Siendo estas nocivas para nuestra comunidad y posible trasmisora de enfermedades” (véase el informe).
  • d)Consta respuesta a los denunciantes por parte del Ministerio de Salud, mediante el Oficio MS-DRRSCH-DARSCÑ-316-2021, de fecha 21 de julio del 2021, donde se indicó: “Que se trasladará caso a Municipalidad de Cañas para la limpieza respectiva. Al tratarse de un problema generalizado de aguas residuales en su barrio, la situación se tratará en la Comisión de Aguas Residuales de Cañas, con el fin de buscar una solución colectiva al problema…”. Además, consta correo electrónico de remisión con copia al alcalde Municipal y a la Comisión de Aguas Residuales” (véase el informe).

IV. SOBRE EL DERECHO A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO

Debe indicarse, en primer lugar, que los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado, se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89, de la Constitución Política), así como a través de la normativa internacional aplicable en Costa Rica. En este sentido, en Sentencia N° 2006-005928 de las 15:00 horas del 2 de mayo del 2006, este Tribunal resolvió: “(…) El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental. Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política.

Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública. En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de “calidad ambiental” como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras –principio de desarrollo sostenible–”. Asimismo, del artículo 50, de la Constitución Política, se deriva la obligación del Estado de proteger el ambiente.

Norma que establece al efecto: "El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes". Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado.

V. SOBRE LA COORDINACIÓN DE LAS INSTITUCIONES PÚBLICAS EN LA PROTECCIÓN INTEGRAL AL AMBIENTE

Existe una obligación para el Estado -como un todo- de tomar las medidas necesarias para proteger el ambiente, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan en peligro la salud de los administrados. En esta tarea, por institución pública se entiende tanto a la Administración Central -Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud-, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia. Del mismo modo, en esta tarea tienen gran responsabilidad las municipalidades en lo que respecta a su jurisdicción territorial. Debido a la diversidad de actores que pueden intervenir, podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa.

Por ello, a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala se ha referido ya al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes, al señalar, mediante Sentencia N.º 5445-99, de las 14:30 horas del 14 de julio de 1999, que: "La coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes.

Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector".

VI. EN CUANTO A LO RESUELTO EN EL EXPEDIENTE NO

22-012991-0007-CO. Por sentencia No. 2022-23977 de las 09:20 horas del 14 de octubre de 2022, la Sala Constitucional conoció de un recurso de amparo que tuvo como objeto lo siguiente:

“II.- OBJETO DEL RECURSO. La recurrente indica que en reiteradas ocasiones ha tratado de llegar a un acuerdo con la Municipalidad de Cañas debido al problema de aguas residuales que sufre el cantón de Cañas, el cual ocasiona severos daños al inmueble de su representada, al medio ambiente y al ganado de engorde que permanece en el sitio; sin embargo, reclama que ni el gobierno local ni las entidades correspondientes han resuelto la situación denunciada”.

En esa oportunidad, la Sala Constitucional -en lo que interesa- resolvió:

“Ahora bien, del estudio del sub judice se determina que las autoridades recurridas han mantenido activas las diligencias del caso, tanto que en el 2019 crearon la Comisión de Aguas Residuales, conformada por el Ministerio de Salud -coordinador-, la Municipalidad de Cañas -representante local- y el Instituto Costarricense de Acueductos y Alcantarillados -competente en la materia, al igual que el Ministerio de Salud-, para analizar y buscar una solución a la problemática que aqueja el cantón de Cañas. Además, se comprueba que la Municipalidad de Cañas ha realizado trabajos en el sistema de aguas pluviales para mejorar su funcionamiento y así evitar el estancamiento de las aguas de lluvia y la proliferación de vectores que puedan afectar la salud, además, ha construido cabezales de alcantarillas y cunetas para encauzar las aguas de origen pluvial a su cauce natural, con el fin de que no discurran por la calle pública y no provoquen desbordamientos; el Ministerio de Salud (Área Rectora de Salud de Cañas) ha emitiendo órdenes sanitarias a los dueños de las viviendas que descargan las aguas residuales de manera indebida y ha testimoniado piezas ante el Ministerio Público ante el incumplimiento de los ciudadanos, además, el Ministerio de Salud en conjunto con el Instituto Costarricense de Acueductos y Alcantarillados, ha recabado información sobre las comunidades prioritarias para la atención de la problemática de aguas residuales en el cantón de Cañas, la cantidad de servicios de alcantarillado sanitario conectados al sistema versus la población que no cuentan con el mismo, el estado del sistema de red de alcantarillado y la capacidad de planta o lagunas de tratamiento, entre otras actuaciones; sin embargo, tales acciones no han sido ni son suficientes, pues los propios accionados han informado que no es viable una solución a nivel local ni individual, pues requieren de un mega proyecto de gran complejidad técnica y presupuestaria para resolver -de manera integral- la situación objeto de este amparo.

Aunado a los anterior, las autoridades recurridas informaron que ya plantearon la problemática ante los jerarcas del Ministerio de Salud, la Presidencia Ejecutiva Instituto Costarricense de Acueductos y Alcantarillados y la Asamblea Legislativa para que tomen las decisiones respectivas de acuerdo con el proyecto de gran envergadura que se necesita, además, tanto el Ministerio de Salud como el Instituto Costarricense de Acueductos y Alcantarillados han planteado una hoja de ruta en los informes rendidos a este Tribunal; sin embargo, no detallan cual es el plan oficial, la fecha próxima de inicio, la forma de ejecución y la fecha de culminación del proyecto, pues únicamente hacen referencia a posibles soluciones.

Resulta importante indicar que las autoridades accionadas tienen la responsabilidad de procurar, dentro del marco de sus competencias, la gestión diligente de los procesos, así como el deber de procurar una solución pronta y eficaz a la situación objeto del recurso, pues resulta innegable que la problemática denunciada podría representar una amenaza al derecho fundamental a un ambiente sano y ecológicamente equilibrado. En razón de lo expuesto, este Tribunal constata una lesión a los derechos fundamentales de la recurrente y de los vecinos afectados del cantón de Cañas. En consecuencia, lo procedente es declarar con lugar el recurso, como se expondrá en la parte dispositiva de esta sentencia”.

En la parte dispositiva de la sentencia se dispuso:

Se declara con lugar el recurso. Se ordena a Nombre04, en su condición de Alcaldesa de Cañas, a Nombre05, en su condición de Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados y a Nombre07, en su condición de Jefe del Área Rectora de Salud de Cañas, o a quienes ocupen esos cargos, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus respectivas competencias para que, dentro del plazo no mayor a TREINTA Y SEIS MESES, contados a partir de la notificación de esta sentencia, resuelva de manera definitiva e integral la problemática que enfrenta el cantón de Cañas (principalmente en las comunidades de Bello Horizonte, La Gran Piedra, Pedregal, así como también La Corte, Los Malinches, Barrio Chorotega, Las Palmas, El Bosquecito, San Antonio, Barrio Unión, San Martín, Las Cañas, Villa Esperanza, Miguel Araya, San Cristóbal Sur, Imas, y Barrio San Martín) respecto al problema de aguas residuales”.

VII. SOBRE EL CASO CONCRETO

De los informes rendidos por los representantes de la autoridad recurrida -que se tienen dados bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44, de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, se tiene por debidamente acreditado que el alcantarillado sanitario de Cañas es el único mixto a nivel nacional; es decir, recoge tanto las aguas residuales como las aguas de lluvia en una misma tubería (alcantarillado pluvial), la cual tiene más de cuarenta años de antigüedad, situación que todas las autoridades recurridas conocen y afirman en los informes rendidos bajo juramento.

Ahora bien, del estudio del sub judice se determina que las autoridades recurridas han mantenido activas las diligencias del caso, tanto que en el 2019 crearon la Comisión de Aguas Residuales, conformada por el Ministerio de Salud -coordinador-, la Municipalidad de Cañas -representante local- y el Instituto Costarricense de Acueductos y Alcantarillados -competente en la materia, al igual que el Ministerio de Salud-, para analizar y buscar una solución a la problemática que aqueja el cantón de Cañas. Además, se comprueba que la Municipalidad de Cañas ha realizado trabajos en el sistema de aguas pluviales para mejorar su funcionamiento y así evitar el estancamiento de las aguas de lluvia y la proliferación de vectores que puedan afectar la salud, además, ha construido cabezales de alcantarillas y cunetas para encauzar las aguas de origen pluvial a su cauce natural, con el fin de que no discurran por la calle pública y no provoquen desbordamientos; el Ministerio de Salud (Área Rectora de Salud de Cañas) ha emitiendo órdenes sanitarias a los dueños de las viviendas que descargan las aguas residuales de manera indebida y ha testimoniado piezas ante el Ministerio Público ante el incumplimiento de los ciudadanos, además, el Ministerio de Salud en conjunto con el Instituto Costarricense de Acueductos y Alcantarillados, ha recabado información sobre las comunidades prioritarias para la atención de la problemática de aguas residuales en el cantón de Cañas, la cantidad de servicios de alcantarillado sanitario conectados al sistema versus la población que no cuentan con el mismo, el estado del sistema de red de alcantarillado y la capacidad de planta o lagunas de tratamiento, entre otras actuaciones.

Sin embargo -tal y como se resolvió en la sentencia No. 2022-23977 de las 09:20 horas del 14 de octubre de 2022- tales acciones no han sido ni son suficientes, pues los propios accionados han informado que no es viable una solución a nivel local ni individual, pues requieren de un mega proyecto de gran complejidad técnica y presupuestaria para resolver -de manera integral- la situación objeto de este amparo. Aunado a los anterior, las autoridades recurridas informaron que ya plantearon la problemática ante los jerarcas del Ministerio de Salud, la Presidencia Ejecutiva Instituto Costarricense de Acueductos y Alcantarillados y la Asamblea Legislativa para que tomen las decisiones respectivas de acuerdo con el proyecto de gran envergadura que se necesita, además, tanto el Ministerio de Salud como el Instituto Costarricense de Acueductos y Alcantarillados han planteado una hoja de ruta en los informes rendidos a este Tribunal; sin embargo, no detallan cual es el plan oficial, la fecha próxima de inicio, la forma de ejecución y la fecha de culminación del proyecto, pues únicamente hacen referencia a posibles soluciones.

Resulta importante indicar que las autoridades accionadas tienen la responsabilidad de procurar, dentro del marco de sus competencias, la gestión diligente de los procesos, así como el deber de procurar una solución pronta y eficaz a la situación objeto del recurso, pues resulta innegable que la problemática denunciada podría representar una amenaza al derecho fundamental a un ambiente sano y ecológicamente equilibrado. En razón de lo expuesto, este Tribunal constata una lesión a los derechos fundamentales de la recurrente y de los vecinos afectados del cantón de Cañas. En consecuencia, lo procedente -de conformidad con la sentencia No. 2022-23977 de las 09:20 horas del 14 de octubre de 2022- es declarar con lugar el recurso, como se expondrá en la parte dispositiva de esta sentencia.

VIII. VOTO SALVADO DE LOS MAGISTRADOS Nombre08 Y Nombre09, CON REDACCIÓN DEL PRIMERO

Con el debido respeto, disentimos del voto de mayoría que declara con lugar el recurso, con base en las siguientes razones:

La protección a un ambiente sano y ecológicamente equilibrado, en el Ordenamiento Jurídico Costarricense, está tutelado no solo en el artículo 50, de la Constitución Política, sino también en una serie de leyes y decretos ejecutivos (reglamentos) vigentes, tales como la Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; la Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; y el Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), para citar solo algunos. Esto hace necesario, en materia ambiental, separar el control de constitucionalidad del control de legalidad. En este sentido, es criterio de los suscritos que esta Sala, por vía de amparo, solo debe conocer un asunto en que se alega violación al derecho a un ambiente sano y ecológicamente equilibrado, si la Administración no ha intervenido aún y cuando la violación a ese derecho sea manifiesta y evidente, de fácil constatación, de cierta importancia o gravedad y que afecte, de forma directa, a alguna persona o comunidad en concreto.

De lo contrario, el tema debe plantearse y discutirse en la vía de legalidad. Por ello, el simple incumplimiento de obligaciones y deberes impuestos legalmente a las diversas administraciones públicas en materia ambiental es propio de ser conocido en la vía de legalidad –administrativa o jurisdiccional-, donde, con mucha mayor amplitud, podrán fiscalizarse los incumplimientos u omisiones que se acusen. Debe tenerse presente que el recurso de amparo es un proceso sumario, informal, sencillo y rápido, de manera tal, que desde el momento mismo en que la Administración interviene en un asunto ambiental, en ejercicio de sus competencias, y sustancia un procedimiento, con el dictado de actos administrativos, su conocimiento resulta ajeno al ámbito de acción de esta jurisdicción especializada. Por ello, la revisión de las actuaciones administrativas llevadas a cabo en torno a un tema ambiental que requiera, para su correcta valoración, de un proceso de conocimiento pleno, solo es posible en la jurisdicción ordinaria, toda vez que el diseño del proceso de amparo es incompatible con la contrastación o revisión de criterios técnicos o jurídicos elaborados al amparo de las normas legales o reglamentarias vigentes o con la evacuación de nuevos y mayores elementos de convicción necesarios para la contrastación o revisión de los criterios que ya consten en el expediente administrativo del caso.

Lo contrario implicaría transformar el amparo en un proceso ordinario de pleno conocimiento, con lo cual se desnaturalizaría y se tornarían nugatorios los fines para los cuales ha sido diseñado, con lo cual, perdería su condición de instrumento para la tutela eficaz de los derechos fundamentales. Como consecuencia de lo anterior, estimamos que cuando un ente u órgano público ha intervenido, en diversas formas, o ha dictado actos administrativos en relación con un asunto ambiental, su conocimiento y fiscalización corresponde a la jurisdicción de lo contencioso-administrativo. Es, precisamente, la verificación de la existencia de esa intervención administrativa lo que determina que el asunto sea competencia de la vía legalidad. En consecuencia, este recurso debió haberse rechazado de plano, ya que su objeto es una cuestión propia de ser discutida, analizada y resuelta en la vía de legalidad.

Empero, como no se hizo así, lo procedente es declararlo sin lugar, sin hacer pronunciamiento alguno con respecto al fondo de la cuestión planteada por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.

IX. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes, que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del Despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara con lugar el recurso. Se ordena a Nombre04, en su condición de Alcaldesa de Cañas, a Nombre05, en su condición de Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados y a Nombre07, en su condición de Jefe del Área Rectora de Salud de Cañas, o a quienes ocupen esos cargos, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus respectivas competencias para que, dentro del plazo no mayor a TREINTA Y SEIS MESES, contados a partir de la notificación de la sentencia No. 2022-23977 de las 09:20 horas del 14 de octubre de 2022, resuelva de manera definitiva e integral la problemática que enfrenta el cantón de Cañas, específicamente en el Dirección02, respecto al problema de aguas residuales. Se les advierte que, de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71, de la Ley de esta Jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena al Estado, a la Municipalidad de Cañas y al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Los Magistrados Nombre08 y Nombre09 salvan el voto y declaran sin lugar el recurso, por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado. Notifíquese.
