Document Review Decision No. 2022003950 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine thirty on dieciocho de febrero de dos mil veintidos.
Amparo proceeding (recurso de amparo) processed under case file No. 21-021282-0007-CO, filed by Nombre01, identity card CED01, on behalf of CONDOMINIO MALLORCA, against MUNICIPALIDAD DE CURRIDABAT AND MINISTERIO DE SALUD.
Findings of Fact (Resultando):
Gustavo Mora, Biologist José Retana, and Ms. María del Mar Saborío on behalf of the Municipality, as well as Francisco Echeverría, Flor Rojas, and the petitioner (recurrente), Nombre01, on behalf of the community. During this meeting, the community representatives were presented with the results of the studies commissioned to better understand the associated problem, which is complex and relates to a watershed spatial unit (unidad espacial de cuenca hidrográfica) that even extends beyond administrative cantonal boundaries and therefore requires a series of actions to minimize vulnerability to flooding. The preventive cleaning program (programa de limpieza preventiva) for the area was also presented, which is carried out every 2 or 3 weeks during the rainy season. The community was further informed that the complete design, construction plans, schedule, and detailed budget for the cantonal bridge to Cipreses were already available and that a funding source was being sought.
In addition, official letter MC-GIR-0043-04-2021 concerning prevention and mitigation measures (acciones de prevención y mitigación) to address flood vulnerability in the BAC-Mallorca area is attached; it details the actions taken during recent periods jointly by the Road Management Directorate and the Risk Management Unit. Also attached is official letter MV-GV-0780-08-2020, sent to the petitioner, Ms. Nombre01, documenting the follow-up and assistance provided to the residents. Accordingly, the foregoing makes clear that the Municipalidad de Curridabat, through the Dirección de Gestión Vial, Departamento de Gestión Integral del Riesgo, and Departamento de Protección al Medio Ambiente, has indeed been carrying out the necessary actions, not only by managing works and coordinating with MOPT and CONAVI, but also by undertaking preventive works and measures to provide a solution to the overflow problems of the río María Aguilar.
It must likewise be understood that both the Ministerio de Obras Públicas y Transportes and CONAVI must take the necessary action within the right-of-way (derecho de vía) of national route 02.” Reference is made to the complexity of the problem, whose solution requires a watershed-based approach (enfoque de cuenca hidrográfica) involving various courses of action in both the public and private sectors. It states that the studies demonstrate that reducing flood risk in the area requires preventive and mitigation measures involving the municipality, MOPT, CONAVI, the residents of Condominio Mallorca, and future upstream developers (desarrolladores aguas arriba), both within and outside the canton. The first measure would be to increase the hydraulic capacity (capacidad hidráulica) of the bridge on the cantonal route to Cipreses and the bridge on RN02. In addition, the hydrological-hydraulic models (modelos hidrológicos-hidráulicos) should be updated.
It concludes that the problem cannot be solved through dredging. According to the studies, that measure would cause greater erosion, instability, environmental damage, and water velocity, potentially shifting the flooding to another nearby location. Moreover, the measure would have to be repeated whenever heavy rainfall occurs because sediment accumulates rapidly in that area. It reproduces the study’s conclusions. It lists the response measures: a) Commissioning technical studies to provide expert opinions regarding possible solutions in a complex area; b) Preventive cleaning programs, as well as cleaning the entire area after an emergency, including bridges and routes under national jurisdiction; c) Specialized cleaning, such as the complex removal of a bamboo clump (cepa de bambú) from the protection area (área de protección) and channel, an action made necessary because a property owner engaged in improper construction practices; d) Repeated assistance to residents through meetings, emails, and telephone calls; e) Risk-prevention and mitigation projects (proyectos de prevención y mitigación del riesgo): 1.
Participation in the Agencia Intermunicipal de la Cuenca del río María Aguilar; 2. Inclusion in the proposed Plan Regulador; 3. Replacement of the bridge on the cantonal route; 4. Coordination with agencies such as CNE, MOPT, and CONAVI. They request that the appeal (recurso) be dismissed.
However, technical report CNE-UIAR-INF-0487-2019 of the Comisión Nacional de Emergencias (CNE), in Section VI, Recommendations, item D, calls for the involvement of the Corporación Municipal del cantón de Curridabat and the Ministerio de Salud in “assessments of the quality and volume of water discharged directly into the channel of the río María Aguilar.” It should be clarified, however, that those assessments fall under the responsibility of the Instituto Costarricense de Acueductos y Alcantarillados (ICAA), which has a water-quality analysis laboratory for conducting tests based on the “Dutch Water Quality Assessment Index” (Dutch WQI), as stipulated in the Reglamento para la Evaluación y Clasificación de la Calidad de Cuerpos de Agua Superficiales, Decreto Ejecutivo Nº 33903-MINAE-S. From the foregoing, Honorable Justices, it is apparent that the allegations against this Ministerio de Salud are unfounded, given that this Área Rectora de Salud, as well as those comprising the Comité Local del Corredor Biológico Interurbano Río María Aguilar, have been monitoring and addressing the situation involving that watershed (cuenca) and other urban micro-watersheds (microcuencas) for many years before the petitioner herein brought the situation to our attention. Accordingly, the petitioner is incorrect in arguing that the matter has not been addressed.” It requests that the application for constitutional relief (recurso de amparo) be dismissed.
Justice Rueda Leal drafts the opinion; and, Whereas (Considerando):
I.Preliminary clarification. Before analyzing the merits of the matter, it must be clarified that, since judgment number 2008-02545 issued at 08:55 horas del 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública (artículos 261 y 325) or by sector-specific laws governing special administrative proceedings (procedimientos administrativos especiales), either to conclude an administrative proceeding—initiated ex officio or at the request of a party—by issuing a final administrative act (acto final), or to hear the applicable administrative appeals (recursos administrativos). Specifically, the sub lite presents an exception because it concerns environmental matters. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this amparo proceeding (amparo).
II.Subject matter of the petition. The petitioner states that Nombre02 overflowed on 23 de setiembre de 2021, affecting nearby residents, including the Mallorca condominium. She asserts that the respondent municipality has not adequately addressed this problem and has instead aggravated it by granting construction permits in the area. She alleges: 1.- The municipal studies concerning the problem were forwarded to the Área Rectora de Salud Curridabat on 22 de octubre de 2019; however, she has received no response; 2.- The municipality has failed to comply with recommendations issued by the CNE and the CGR (official letter DFOE-DL-IF-00012-2019); 3.- Sediment has accumulated in the channel, reducing the river’s capacity and causing the water to overflow; however, the municipality’s work has been corrective when it should be preventive; 4.- She alleges noncompliance with judgment n.° 2018-17706.
As regards MOPT, the petitioner asserts that this agency is responsible for maintaining the bridge on route 2, where overflows occur because of sediment accumulation. She states that the respondent municipality sent official letters MC-DGV-289-05-2021, MC-ALC-0614-08-2021, and MC-ALC-0869-10-2021 to the minister of that ministry; however, none was answered by the minister. She requests that the ministry submit a remedial plan to intervene at the aforementioned bridge.
III.Proven facts. For purposes of deciding this matter, the following facts are deemed duly established, either because they have been proven or because the respondent failed to address them as directed in the initial order:
We must also indicate that, since 2003, we have made efforts to have Municipalidad de Curridabat intervene, but to date we have not received a satisfactory response that would eliminate the imminent risks to the population concerned. Sincerely, we await your response.” (See petition initiating the proceeding and evidence provided).
We reiterate once again our concern about the flooding experienced, pollution, stress, and traffic problems, which we have expressed extensively on various occasions. This situation arises whenever it rains heavily, and we do not know how much longer we will have to deal with this reality. As always, we also offer to contribute in whatever way is within our reach to the foregoing proposal while broader technical and effective solutions are developed. It is clear that cleaning Nombre02 would be consistent not only with the provisions of Article 50 of our Political Constitution, but also with the very image of the canton under your direction. We await your prompt response within the time limits established by law.” (See petition initiating the proceeding and evidence submitted).
IV.Unproven facts. The Chamber lacks evidence to find it proven that the Área Rectora de Salud de Curridabat responded in any way to the appellant’s written request dated 22 de octubre de 2019.
V.Case law. Because of its importance to this case, the Chamber recalls its case law regarding the right to a healthy and ecologically balanced environment (ambiente sano y ecológicamente equilibrado) and the obligations of municipal corporations in that regard. In Judgment n.° 2020-10630, issued at 9:15 hours on 12 de junio de 2020:
“III.- ON THE PROTECTION OF THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT. Article 50 of the Constitution establishes, as a fundamental purpose and essential value of the Costa Rican State, the pursuit of ‘the greatest well-being of all the country’s inhabitants.’ Accordingly, the ‘healthy and ecologically balanced environment’ forms part of the greatest well-being of all inhabitants and constitutes the cause, purpose, condition, and limit of the exercise of public powers and authority, not only by the State but also by the Municipalities. As with the right to property, the subject matter of the right to the environment lies outside the integrity of the human person—unlike, for example, the right to life. However, also unlike the subject matter of the right to property, the person forms part of and is integrated into the environment. Its protection therefore entails preserving the context essential to human life. Conduct that adversely affects it poses a threat to human existence itself and reduces or eliminates the ‘greatest well-being’ of all. Life depends on the environment; consequently, care must be taken to ensure that the conditions guaranteeing life are maintained over time. In Judgment N° 601-2009, this Chamber held as follows:
‘The origins of environmental problems are complex and arise from an interrelationship of natural and social processes within the framework of the socioeconomic development model adopted by the country. For example, environmental problems arise when methods of exploiting natural resources cause ecosystem degradation (degradación de los ecosistemas) that exceeds their regenerative capacity, thereby harming broad sectors of the population and generating high environmental and social costs that lead to a deterioration in quality of life; indeed, the primary purpose of using and protecting the environment is to achieve development and progress favorable to human beings (..) It is important to understand that, although human beings have the right to use the environment for their own development, they also have the duty to protect and preserve it for present and future generations. This is not particularly novel, because it is simply the application to this field of the principle of “injury” (principio de la “lesión”), already firmly established in ordinary law, under which the lawful exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself.’ Accordingly, public entities, including the Municipalities, are responsible for safeguarding respect for a healthy and ecologically balanced environment within their respective territorial jurisdictions, as well as the well-being of all the inhabitants of their respective cantons.
Within the framework of their constitutional and statutory authority, they must act to ensure that this right is respected for all residents of the municipality and—again within the framework of their authority—to mitigate or correct actions tending to violate it.
Municipal authority and the obligation of interinstitutional coordination. Article 169 of the Political Constitution provides that ‘The administration of local interests and services in each canton shall be entrusted to the Municipal Government (...).’ This provision has been developed by the ordinary legislature. Accordingly, Article 3 of the Municipal Code, Law N° 7794 of 30 de abril de 1998, provides that: ‘The governance and administration of cantonal interests and services shall be entrusted to the municipal government.’ The Constitutional Chamber has expressed the same view in its case law. For example, Judgment N° 5445-99, issued at 14:30 hours on 14 de julio de 1999, held as follows:
‘VI.- THE POWERS OF MUNICIPALITIES ACCORDING TO SUBJECT MATTER (THE CONCEPT OF “LOCAL MATTERS” (LO LOCAL)). By express constitutional provision—Article 169—functions or powers concerning “local matters” are assigned to local governments, namely, “the administration of the services and interests” of the locality within their jurisdiction, for which purpose they are granted autonomy (”). Accordingly, their powers are general, insofar as there is no detailed enumeration of their specific responsibilities, but merely a statement of the scope of their authority. Nevertheless, that scope can be determined, as this Court stated in Judgment number 6469-97, issued at sixteen hours and twenty minutes on ocho de octubre de mil novecientos noventa y siete, in the following terms:
“(...) local matters have such significance that defining their scope, whether by the legislature or the courts, must lead to preserving the integrity of local interests and services (intereses y servicios locales), such that not even the legislature could enact legislation aimed at dismembering the Municipality (territorial element), unless it did so in accordance with the procedures previously established in the Political Constitution; nor could it enact legislation that placed its inhabitants (population) at a clear disadvantage in relation to the rest of the country; nor legislation affecting the very essence of local matters (government), such that the Corporation would become a mere empty shell, retaining only its name while dismantling the entire system as conceived by the National Constituent Assembly. Put differently, there are functions that, by their nature, are municipal—local—and cannot be removed from that sphere of jurisdiction (ámbito de competencia) and converted into national services or interests, because doing so would entail dismantling the Municipality or, more precisely, stripping it of its constitutional substance; therefore, it is not possible to prescribe in advance the inviolable limits of local matters. Rather, determining what does or does not fall within the purview of community government must be derived from an examination of each specific case (...)”. The foregoing highlights the fact that, by the express will of our Fundamental Charter, specific jurisdiction (competencia específica) is assigned to local governments, and that authority is also exclusive to them; that is, it is an original jurisdiction (competencia originaria) of the municipality and may be displaced, wholly or partially, only through a nationalization or regionalization law.”
Consequently, if a group of municipal residents (munícipes), within their territorial jurisdiction (circunscripción territorial), suffer flooding that endangers their lives and causes serious property damage, psychological harm, and impairment of their quality of life and general well-being, this falls within the concept of “local interests and services” under constitutional numeral 169. The causes of such problems—and, even more importantly, their solutions—must be precisely identified so that those solutions may be implemented as soon as possible; to that end, the Municipality must coordinate with national-level institutions having jurisdiction to address the problem. Indeed, the Sala has already developed the municipality’s obligation to coordinate with other state institutions in order to safeguard “interests” and duly provide “local services.” In the aforementioned Judgment No. 5445-99, the Sala stated:
“(...) they concern the duty of coordination (obligación de coordinación) that must exist among local governments, decentralized institutions, and the Executive Branch in order to carry out the functions entrusted to them, which must be analyzed in light of the very nature of municipal autonomy (autonomía municipal). By virtue of the provisions of constitutional Article 170, municipalities (local corporate entities) enjoy functional, administrative, and financial autonomy in administering local interests and services (Article 169 of the Political Constitution) (...) Accordingly, no conflict based on antagonism or rivalry may be created between the matters encompassed by the general purpose of ‘local interests and services’ and ‘national’ or ‘state’ public interests and services, which are intrinsically distinct from one another but are, in fact, intended to coexist (....) Once the municipality’s subject-matter jurisdiction (competencia material) within a given territorial jurisdiction has been defined, it is clear that some functions are, by their nature, exclusively municipal, alongside others that may be regarded as national or state functions. It is therefore essential to define the form of joint exercise of powers (cooparticipación de atribuciones) that inevitably results, because the public authority of municipalities is local, while that of the State and other entities is national; consequently, municipal territory is simultaneously state and institutional territory, insofar as circumstances so require. In other words, municipalities may share their powers with the Public Administration in general, and that relationship must operate under the terms established by law (Article 5 of the former Municipal Code, Article 7 of the new Code), which establishes a duty of ‘coordination’ between municipalities and the public institutions that concurrently exercise their powers, in order to prevent duplication of efforts and contradictions, particularly because only voluntary coordination is compatible with municipal autonomy, as an expression thereof. Put differently, a municipality is called upon to enter into cooperative relationships with other public entities, and vice versa, given that, in many cases, their interests regarding a specific matter are concurrent or overlapping. In legal scholarship, coordination is defined by the existence of several independent centers of action, each with its own functions and decision-making powers, which may at times diverge; notwithstanding this, there must be a commonality of subject-matter objectives arising from their concurrent involvement, insofar as the object receiving the final results of each one’s activities and acts is shared.” Thus, coordination is the ordering of relationships among these various independent activities, taking account of their convergence upon the same object or entity so as to make it useful to an overall public plan, without eliminating the reciprocal independence of the participating entities. Because there is no hierarchical relationship involving decentralized institutions, or even the State itself, vis-à-vis municipalities, specific courses of conduct cannot be imposed upon them; this gives rise to the indispensable interinstitutional ‘concerted action’ (concierto), in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and overall framework, within which each performs a role with a view to a mission entrusted to the others.”
It should further be noted that, under the imperative mandate of numeral 50 of the Political Constitution, the Municipalities are required to devote themselves to protecting the environment (Judgment No. 2006-7994 at 8:57 a.m. on June 2, 2006).”
VI.Regarding the Área Rectora de Salud. The petitioner (accionante) alleges that on October 22, 2019, she sent the Área Rectora de Salud Curridabat municipal studies concerning the problem at issue in these proceedings; however, she has received no response. After reviewing the record, the Sala deemed it proven that the appellant (recurrente) did in fact submit a document to that governing area, stating: “Attached please find the Technical Report of the Comisión Nacional de Emergencia, (CNE), prepared on June 19, 2019, CNEUIAR-INF-0487-20 19, whose stated objectives are: (…) It is our intention to bring this document to your attention, given the serious concern raised by the matters described therein that directly relate to the environment: standing water, garbage, pipes in poor condition—some of which apparently may carry sewage—among other troubling matters identified in the aforementioned CNE report.
All these circumstances create health risks for the densely populated and highly vulnerable areas surrounding the Río María Aguilar, specifically along the stretch from Cipreses to downstream of Condominio Mallorca, thereby endangering the health of that population. This situation should serve as a warning sign so that the necessary measures are taken to prevent future disasters, while also broadening the technical criteria that may help provide safety and quality of life in this highly vulnerable area. We further note that, since 2003, we have made efforts to secure intervention by Municipalidad de Curridabat, but to date have received no satisfactory response eliminating the imminent risks to the affected population. Sincerely, we await your response.” With respect to this grievance (agravio), the respondent (recurrida) argues that the petitioner did not specify the harm she suffers, because the CNE report takes a general approach.
The Sala could not deem it proven that the Área Rectora de Salud de Curridabat addressed the petitioner’s aforementioned submission in any manner. After assessing the note sent by the petitioner, the Sala finds no specific claim (pretensión concreta) directed to the respondent governing area, since her intention was that “…this document be brought to your attention…”. The vagueness of such a claim cannot give rise to an expectation on the appellant’s part that it will be addressed. Likewise, no specific enforceable action is identified in relation to the situation of the Río María Aguilar. Nor can the Sala attribute inaction to that governing health area, since it has participated since 2010 in the Corredor Biológico Interurbano Nombre02 initiative and also in the Estrategia Nacional de recuperación de cuencas urbanas 2020-2030, carrying out actions within its jurisdiction. These considerations warrant dismissing the claim.
VII.Concerning compliance with the recommendations of the CNE and the CGR. The petitioner alleges that Municipalidad de Curridabat has failed to comply with the recommendations of the CNE and the CGR. With respect to the CNE, she cites official communications (oficios) Nos. DL-OF-198-2012 and CNE-UIAR-INF-0487-2019. The Sala notes that compliance with the former was addressed in Judgment No. 2018-17706 at 9:20 a.m. on October 26, 2018, issued in case file (expediente) 18-006757-0007-CO, which ruled:
“The appeal is granted solely with respect to the failure to comply with the recommendations issued by the Comisión Nacional de Emergencias to resolve the existing problem caused by the overflow of Nombre02 and its consequences. Alicia Borja Rodríguez, in her capacity as Mayor of Municipalidad de Curridabat, or whoever may hold that office in her stead, is ordered, within the scope of her authority, to adopt the appropriate measures so that, within a maximum period of SIX MONTHS from service of this decision, a solution is provided to the reported problem affecting the appellants (…)”.
Furthermore, with respect to official communication No. CNE-UIAR-INF-0487-2019, the Sala held in Decision No. 2019-014352 at 2:20 p.m. on August 1, 2019, also issued in case file 18-006757-0007-CO, that the report was a follow-up to No. DL-OF-198-2012 and should not be heard by the Sala:
“II.- Finally, with respect to Technical Report No. CNE-UIAR-INF- 0487-2019, signed by the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias and entitled ‘Inspection and assessment of the existing situation along the Nombre02 highway to Cartago, Dirección07 section,’ according to the respondent authority, it is a follow-up to Report DPMINF- 0514-2012 and does not indicate any failure to comply by the respondent municipality. The record likewise shows that, through Technical Report No. MC-GR-0064-07-2019 of July 11, 2019, the Risk Management Unit of the respondent municipality informed the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias of the dates and locations where routine and extraordinary cleanups had been conducted in the area in an effort to provide a solution to the alleged problem—information that the Commission did not possess and that concerns the work performed by the municipality to comply with the aforementioned judgment. Accordingly, because it has been determined that the report concerns follow-up conducted by the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, which neither constitutes new facts that must be heard by this Sala nor affects compliance with Judgment 2018- 017706 at 9:20 a.m. on October 26, 2018, the application must be declared inadmissible as to this issue.” (Underlining added).
The party shall abide by what was decided therein.
Regarding the recommendations of the CGR, the Chamber deemed it proven that it issued the “Operational Audit Report on the Management of the Stormwater Drainage Service in the Municipalidad de Curridabat” (official letter n.° DFOE-DL-IF-00012-2019 of 6 September 2019). With respect to compliance with this report, the Chamber verified that, through official letter DFOE-SD-0456 of 18 March 2021, the CGR informed the Municipalidad de Curridabat that it had reasonably complied with provision 4.6 of that report. Subsequently, through official letter DFOE-SEM-0936 of 5 October 2021, the CGR stated that the municipality had complied with item 4.4 of the aforementioned report. Upon analyzing the report, the only item that apparently has not been complied with is 4.5., which instructs the mayor of Curridabat to:
“Prepare a technical study to ascertain the current condition of the existing stormwater drainage system (sistema de alcantarillado pluvial), providing data and technical criteria such as the hydraulic capacity (capacidad hidráulica) of the system’s components, hydrological risks, vulnerabilities, materials and condition of the infrastructure, age, service life, among others, in order subsequently to determine stormwater drainage maintenance and investment needs. Once that study has been completed, define a portfolio of medium- and long-term projects in accordance with the maintenance and investment needs identified in the technical study (see paragraphs 2.20 through 2.31). To that end, the following must be submitted to the Área de Seguimiento de Disposiciones de la Contraloría General de la República: i. An official letter stating that the technical study has been prepared in accordance with the stipulated terms, no later than 30 June 2020. ii.
An official letter stating that the project portfolio has been prepared, no later than 01 October 2020.” That said, the Chamber determines that this Court is not a body responsible for overseeing each institution’s compliance with its obligations. Its role is to protect fundamental rights. Accordingly, compliance with an institutional obligation could be eligible for amparo relief (amparable) when directly related to a fundamental right. In this case, the failure to prepare a technical report and subsequently define medium- and long-term projects falls far short of constituting an actual infringement of or threat to fundamental rights. For that reason, the claim is dismissed.
VIII.Regarding the MOPT’s response to official letters MC-DGV-289-05-2021, MC-ALC-0614-08-2021 and MC-ALC-0869-10-2021. The petitioner considers that the MOPT has violated Articles 27 and 30 of the Political Constitution because it has not responded to official letters MC-DGV-289-05-2021, MC-ALC-0614-08-2021 and MC-ALC-0869-10-2021 from the Municipalidad de Curridabat. In this regard, the Chamber deemed it proven that, through official letter DGV-289-05-2021 of 5 May 2021, the mayor of Curridabat informed the respondent minister of the flooding problem involving the río María Aguilar. He requested the minister’s good offices in arranging effective maintenance work to improve the hydraulic capacity of the bridge over Dirección02. In response to this official letter, on 10 June 2021, municipal and MOPT officials inspected the location of the flooding. The deputy director of the MOPT’s Dirección de Obras Fluviales subsequently submitted a report on the inspection to the director of that department and issued recommendations (official letter DVOP-DOF-2021-0627 of 18 June 2021).
Those recommendations were communicated to the respondent municipality by email on 21 June 2021. Subsequently, through official letter MC-ALC-0614-08-2021 of 11 August 2021, addressed to the respondent minister, the mayor of Curridabat followed up on official letter DGV-289-05-2021. He reported that the municipality’s Dirección de Gestión Vial and Departamento de Gestión del Riesgo had conducted an inspection with engineers from the Dirección de Obras Fluviales. He requested information on the action that the MOPT would take and pointed out that a community was vulnerable to the risk of flooding. Then, through official letter MC-ALC-0869-10-2021 of 26 October 2021, the mayor of Curridabat asked the respondent minister to assess and intervene at the locations where Nombre02 causes flooding on national routes. In response to this official letter, the director of the Dirección de Obras Fluviales sent official letter DVOP-DOF-2021-1257 of 3 November 2021 to the respondent minister; that official letter was forwarded to the Municipalidad de Curridabat by email on 4 November 2021.
The Chamber explains to the appellant that the aforementioned official letters are part of interinstitutional coordination (coordinación interinstitucional) aimed at addressing the underlying problem, which will be examined in the following recital (considerando). As such, they are not characterized as petitions or submissions falling within the scope of protection afforded by Articles 27 and 30 of the Constitution. Consequently, the claim is dismissed.
IX.Regarding the flooding problem involving Nombre02 in the Curridabat area. The petitioner states that Nombre02 overflowed on 23 September 2021, affecting local residents, including the Mallorca condominium. She relates that similar events occur every year. She complains that the authorities’ actions are insufficient or merely corrective. After reviewing the record, the Chamber deemed it undisputed that, for approximately 10 years, Nombre02 has overflowed during periods of heavy rainfall in the Curridabat area, where the bridge on national route 2 and the bridge on the municipal route toward Cipreses are located. When this occurs, the flooding affects the residents of the Mallorca condominium. One such event occurred on 23 September 2021, as alleged. The Chamber verified that the Municipalidad de Curridabat has undertaken numerous actions to resolve the problem and safeguard local interests.
In this regard, it notes that, during 2021 and up to the date on which the report was submitted, the municipality had carried out work on Nombre02 on 22 occasions, including stormwater drainage cleaning, inspections, pruning, waste removal, and other tasks. The municipality also has a project to install a network of weather stations that will make it possible to measure rainfall intensity, estimate whether the river is likely to overflow, and issue an alert. The final installation phase of the project was scheduled for completion in 2021. Also highly significant is the municipality’s work toward constructing a new bridge on the cantonal route toward Cipreses. The project was approved by the CFIA, MINAE and SETENA, and the resources for its construction were included in the POA-2022. The work includes intervention in the river channel (cauce), which will increase the hydraulic capacity 100 meters upstream and 75 meters downstream.
Although the Chamber acknowledges these efforts, it is equally true that the flooding and inundation problem in the area persists. The Chamber was already made aware of the situation in 2018, as discussed in the aforementioned judgment n.° 2018-17706. Despite the passage of years, the case file contains no clear course of action indicating that the problem will be resolved within a reasonable period. The principal project is the aforementioned new bridge on the route to Cipreses; nevertheless, no further work has been defined for the downstream area, at the Dirección08 bridge and in the area of the protected party’s condominium. It is clear that the Chamber cannot conduct technical assessments and select a particular project or solution, not only because such matters fall outside its jurisdiction, but also because the parties or the technical reports disagree. Thus, for example, dredging the river is recommended on some occasions, while on others it is stated that doing so would be counterproductive and ineffective.
The Chamber also emphasizes the municipality’s responsibility, since its obligations extend beyond impacts on roads and also encompass land-use planning (ordenamiento territorial), so that urban growth occurs within the framework of a healthy and ecologically balanced environment. That obligation encompasses planning, the issuance of permits, the inspection of works, the monitoring and conservation of locally protected areas (rivers and their banks), and coordination with other municipalities and State entities (recital V). In the Chamber’s view, the problem alleged by the appellant falls within that duty to coordinate and safeguard local and national interests. The proven facts, particularly those detailed in the preceding recital, show that there has been some coordination with the MOPT to address the problem. However, there is no indication that an action plan was finalized, much less implemented.
Under these circumstances, the Chamber must provide the protected parties with certainty regarding the restoration of their rights by issuing the corresponding order. The Chamber recognizes that the scale of the problem makes an immediate solution impossible; hence the length of the period granted, subject to the Chamber’s express reservation of its powers to ensure enforcement of the order (Article 56 of the Ley de la Jurisdicción Constitucional). By virtue of the foregoing, this aspect of the petition is granted on the terms set forth in the operative portion of this judgment.
X.Regarding judgment n.° 2018-17706 issued at 9:20 hours on 26 October 2018. Finally, noncompliance with judgment n.° 2018-17706 of this Chamber is alleged. If the interested party sees fit, she must file and substantiate the corresponding application in the appropriate case file.
XI.Note by Justice Salazar Alvarado. As a matter of principle, I consider that cases relating to the Public Administration’s inaction in repairing, constructing, modifying, or demolishing any infrastructure work should be dismissed because such an omission is a question of legality that must be adjudicated in the ordinary courts, where the interested person may present objections more fully. However, when that administrative omission results in a violation of other fundamental rights protected within this constitutional jurisdiction, or affects groups considered vulnerable, I do examine the merits of the matter because such a situation constitutes an exception to my position on this subject, as is the case here, where the protection of the life, public health, and physical integrity of the appellants and the residents of Condominio Mallorca in Curridabat is at stake due to the flooding of their homes caused by the río María Aguilar overflowing, which results in the current carrying all kinds of garbage and sewage, with evident damage to property as well.
XII.Partial dissenting opinion regarding the operative part of this judgment by Justice Garro Vargas. Although I agree with the majority of the Chamber that the petition should be granted, I partially disagree as to where the enforcement phase (fase de ejecución) of the matter should be conducted, specifically regarding the actions to be established to resolve the overflow and flooding problem of Nombre02 in the area that is the subject of these proceedings, due to the lack of adequate mechanisms provided for in the rules governing this constitutional jurisdiction to monitor compliance with a judgment involving highly complex technical aspects. By contrast, the provisions of the Code of Administrative Litigation Procedure (Código Procesal Contencioso-Administrativo) concerning enforcement (artículo 155 y siguientes) offer clear advantages, such as the possibility of requiring schedules, imposing fines, determining liability, overseeing stages of compliance, etc. Therefore, pursuant to artículo 56 de la Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.
The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, such items must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, artículo XXVI, and published in Boletín Judicial número 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, artículo LXXXI.
Por tanto:
The petition is partially granted, under the terms set forth in Considerando IX of this judgment. Jimmy Cruz Jiménez, Randall Rodríguez Araya, and Óscar Mora Altamirano, respectively mayor, director of road management, and president of the Concejo, all of the Municipalidad de Curridabat, and Rodolfo Méndez Mata, in his capacity as minister of Obras Públicas y Transportes, or whoever holds those offices, are ordered, through interinstitutional coordination (coordinación interinstitucional), to issue the necessary orders within the scope of their authority so that both bodies jointly prepare an action plan to resolve the overflow and flooding problem of Nombre02 in the area that is the subject of these proceedings. The respondents are granted a period of SIX MONTHS from notification of this judgment to prepare the aforementioned plan, and an additional period of THIRTY-SIX MONTHS to implement it.
The respondent authorities are advised that, pursuant to artículo 71 de la Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding (recurso de amparo) that they are required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or to a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Estado and the Municipalidad de Curridabat are ordered to pay the legal costs, damages, and losses caused by the acts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation jurisdiction (contencioso administrativo). Regarding compliance with the recommendations of the Comisión Nacional de Emergencia, the parties shall abide by the rulings in resolutions n.os 2018-17706 of 9:20 hours on 26 de octubre de 2018 and 2019-014352 of 14:20 hours on 1 de agosto de 2019.
In all other respects, the petition is denied. Justice Salazar Alvarado files a separate note. Justice Garro Vargas dissents regarding enforcement of this judgment and, pursuant to artículo 56 de la Ley de la Jurisdicción Constitucional, determines that it must be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del dieciocho de febrero de dos mil veintidos .
Recurso de amparo que se tramita en el expediente n.° 21-021282-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, a favor del CONDOMINIO MALLORCA, contra la MUNICIPALIDAD DE CURRIDABAT Y EL MINISTERIO DE SALUD.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Aclaración previa. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia número 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está frente a materia ambiental. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
II.Objeto del recurso. La parte recurrente relata que el Nombre02 se desbordó el 23 de setiembre de 2021, lo que afectó a los vecinos, incluyendo al condominio Mallorca. Afirma que la municipalidad accionada no ha atendido debidamente este problema y más bien lo ha agravado, al otorgar permisos de construcción en la zona. Acusa: 1.- Los estudios municipales sobre el problema fueron remitidos al Área Rectora de Salud Curridabat el 22 de octubre de 2019; sin embargo, no ha tenido respuesta; 2.- La municipalidad no ha acatado recomendaciones de la CNE y la CGR (oficio DFOE-DL-IF-00012-2019) 3.- Los sedimentos se han acumulado en el cauce, lo que disminuye la capacidad del río y provoca que el agua se desborde; empero, la labor de la municipalidad ha sido correctiva, cuando debería ser preventiva; 4.- Reclama desacato de la sentencia n.° 2018-17706.
En cuanto al MOPT, la parte accionante afirma que esa instancia es encargada del mantenimiento del puente sobre la ruta 2, donde ocurren desbordamientos por la acumulación de sedimentos. Señala que la municipalidad accionada envió al ministro de esa cartera los oficios MC-DGV-289-05-2021, MC-ALC-0614-08-2021 y MC-ALC-0869-10-2021; empero, ninguno fue respondido por el ministro. Solicita que el ministerio presente un plan remedial para intervenir el citado puente.
III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:
No omitimos indicar que desde el año 2003, hemos realizado esfuerzos para que Municipalidad de Curridabat intervenga, sin contar a la fecha con respuesta satisfactoria y que elimine los inminentes riesgos para la población interesada. Cordialmente, en espera de su respuesta.” (Ver escrito de interposición y prueba aportada).
Reiterarnos, una vez más nuestra preocupación, por las inundaciones experimentadas, contaminación, stress, problemas con el tránsito ampliamente externada en diferentes ocasiones. Situación que se da cada vez que llueve fuerte y que no tenemos certeza hasta cuánto más tenderemos que lidiar con esta realidad, además de contribuir como siempre, en lo que a nuestro alcance se pueda hacer, con el anterior planteamiento mientras se tienen soluciones técnicas y efectivas de mayor alcance. Teniendo claridad que la limpieza del Nombre02 vendría a estar acorde con lo que señala el artículo 50 de nuestra Constitución Política, sino con la imagen misma del cantón que usted dirige. Quedamos en espera de su atenta respuesta en los plazos de ley establecidos.” (Ver escrito de interposición y prueba aportada).
IV.Hechos no probados. La Sala carece de elementos para tener por probado el que el Área Rectora de Salud de Curridabat atendiera de alguna manera el escrito del 22 de octubre de 2019 de la recurrente.
V.Jurisprudencia. Por su importancia para este caso, la Sala recuerda su jurisprudencia con respecto al derecho a un ambiente sano y ecológicamente equilibrado y las obligaciones de las corporaciones municipales en ese tema. En la sentencia n.° 2020-10630 de las 9:15 horas del 12 de junio de 2020:
“III.- SOBRE LA PROTECCIÓN DEL DERECHO A UN AMBIENTE SANO Y ECOLOGICAMENTE EQUILIBRADO. El artículo 50, Constitucional, establece como fin fundamental y valor esencial del Estado costarricense procurar "el mayor bienestar a todos los habitantes del país". De tal manera que, el "ambiente sano y ecológicamente equilibrado" forma parte del contenido del mayor bienestar de todos los habitantes, causa, fin y también condición y límite del ejercicio de las potestades y competencias públicas, no solo del Estado, sino también de las Municipalidades. Al igual que el derecho de propiedad, el objeto sobre el que recae el derecho al ambiente es externo a la integridad de la persona humana (a diferencia por ejemplo del derecho a la vida), pero también a diferencia con el objeto del derecho de propiedad, la persona forma parte del ambiente, lo integra, de allí que su protección, supone la conservación del contexto esencial para la vida humana, una conducta con efectos negativos sobre él, supone un peligro para la propia existencia humana y una reducción o pérdida del "mayor bienestar" de todos. La vida depende del ambiente, por tanto, debe velar para que esas condiciones que garantizan la vida se mantengan en el tiempo. En Sentencia N° 601-2009, esta Sala dispuso lo siguiente:
"Los orígenes de los problemas ambientales son complejos y corresponden a una articulación de procesos naturales y sociales en el marco del estilo de desarrollo socioeconómico que adopte el país. Por ejemplo, se producen problemas ambientales cuando las modalidades de explotación de los recursos naturales dan lugar a una degradación de los ecosistemas superior a su capacidad de regeneración, lo que conduce a que amplios sectores de la población resulten perjudicados y se genere un alto costo ambiental y social que redunda en un deterioro de la calidad de vida; pues precisamente el objetivo primordial del uso y protección del ambiente es obtener un desarrollo y evolución favorable al ser humano (..) importante que ello es entender que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene el deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras, lo cual no es tan novedoso, porque no es más que la traducción a esta materia, del principio de la "lesión", ya consolidado en el derecho común, en virtud del cual el legítimo ejercicio de un derecho tiene dos límites esenciales: Por un lado, los iguales derechos de los demás y, por el otro, el ejercicio racional y el disfrute útil del derecho mismo".
Así las cosas, corresponde a los entes públicos, entre ellos a las Municipalidades, velar por el respeto a un ambiente sano y ecológicamente equilibrado en su respectiva circunscripción territorial, así como por el bienestar de todos los habitantes de su respectivo cantón, y dentro del marco de las competencias constitucionales y legales actuar a favor de asegurar el respeto de este derecho a todos los munícipes, y actuar -nuevamente dentro del marco de sus competencias- para mitigar o corregir las actuaciones que tienden a su violación.
Competencia municipal y obligación de coordinación interinstitucional. El artículo 169, de la Constitución Política, dispone que "La administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal (...)". Esta norma ha sido desarrollada por el legislador ordinario, en atención a ello, el artículo 3, del Código Municipal, Ley N° 7794 de 30 de abril de 1998, dispone que: "El gobierno y la administración de los intereses y servicios cantonales estarán a cargo del gobierno municipal". En este mismo sentido, se ha expresado la Sala Constitucional en su jurisprudencia. Verbigracia, en Sentencia N° 5445-99, de las 14:30 horas del 14 de julio de 1999, se dispuso lo siguiente:
"VI.- DE LAS ATRIBUCIONES DE LAS MUNICIPALIDADES EN RAZÓN DE LA MATERIA (CONCEPTO DE "LO LOCAL"). Por disposición constitucional expresa -artículo 169-, hay una asignación de funciones o atribuciones en favor de los gobiernos locales en razón de la materia a "lo local", sea, "la administración de los servicios e intereses" de la localidad a la que está circunscrita, para lo cual se la dota de autonomía (") De manera que sus potestades son genéricas, en tanto no hay una enumeración detallada de sus cometidos propios, sino una simple enunciación del ámbito de su competencia; pero no por ello no determinable, a lo que hizo referencia este Tribunal en sentencia número 6469-97, de las dieciséis horas veinte minutos del ocho de octubre de mil novecientos noventa y siete, en los siguientes términos:
" (...) lo local tiene tal connotación que definir sus alcances por el legislador o el juez, debe conducir al mantenimiento de la integridad de los intereses y servicios locales, de manera que ni siquiera podría el legislador dictar normativa que tienda a desmembrar el Municipio (elemento territorial), si no lo hace observando los procedimientos previamente establecidos en la Constitución Política; ni tampoco promulgar aquella que coloque a sus habitantes (población) en claras condiciones de inferioridad con relación al resto del país; ni la que afecte la esencia misma de lo local (gobierno), de manera que se convierta a la Corporación en un simple contenedor vacío del que subsista solo la nominación, pero desactivando todo el régimen tal y como fue concebido por la Asamblea Nacional Constituyente. En otro giro, habrá cometidos que por su naturaleza son municipales -locales- y no pueden ser substraídos de ese ámbito de competencia para convertirlos en servicios o intereses nacionales, porque hacerlo implicaría desarticular a la Municipalidad, o mejor aún, vaciarla de contenido constitucional, y por ello, no es posible de antemano dictar los límites infranqueables de lo local, sino que para desentrañar lo que corresponde o no al gobierno comunal, deberá extraerse del examen que se haga en cada caso concreto (...)". De lo anterior, resalta el hecho de que, por voluntad expresa de nuestra Carta Fundamental, se asigna una competencia específica a los gobiernos locales, atribución que además es exclusiva de éstos; es decir, se trata de una competencia originaria de la municipalidad y sólo mediante una ley de nacionalización o de regionalización es que puede ser desplazada, total o parcialmente".
En consecuencia, si un grupo de munícipes, en su circunscripción territorial, sufren inundaciones con riesgo para sus vidas y graves daños patrimoniales, psicológicos, calidad de vida y bienestar general, esto se enmarca dentro del concepto de "intereses y servicios locales" del numera 169, constitucional, problemas cuyas causas tienen que ser identificadas con precisión y, más aun, las soluciones, a fin de implementarlas a la mayor brevedad posible; para lo cual corresponde a la Municipalidad coordinar con las instituciones de nivel nacional con competencia para actuar sobre el problema. En efecto, la Sala ya ha desarrollado la obligación municipal de coordinar con otras instituciones estatales en aras de atender los "intereses" y prestar cumplidamente los "servicios locales". En la citada Sentencia N° 5445-99, la Sala manifestó:
"(...) se refieren a la obligación de coordinación que debe existir entre los gobiernos locales, las instituciones descentralizadas y el Poder Ejecutivo, para llevar a cabo las funciones que le han sido encomendadas, lo que debe ser analizado a partir de la naturaleza misma de la autonomía municipal. Es en virtud de lo dispuesto en el artículo 170 constitucional, que las municipalidades (entes corporativos locales) gozan de autonomía funcional, administrativa y financiera en la administración de los intereses y servicios locales (artículo 169 de la Constitución Política) (...) No puede, entonces, crearse un conflicto por antagonismo o protagonismo entre la materia que integra el fin general de "los intereses y servicios locales" de los intereses y servicios públicos "nacionales" o "estatales", intrínsecamente distintos unos de otros, pero que en realidad están llamados a coexistir (....) Definida la competencia material de la municipalidad en una circunscripción territorial determinada, queda claro que habrá cometidos que por su naturaleza son exclusivamente municipales, a la par de otros que pueden ser reputados nacionales o estatales; por ello es esencial definir la forma de cooparticipación de atribuciones que resulta inevitable, puesto que la capacidad pública de las municipalidades es local, y la del Estado y los demás entes, nacional; de donde resulta que el territorio municipal es simultáneamente estatal e institucional, en la medida en que lo exijan las circunstancias. Es decir, las municipalidades pueden compartir sus competencias con la Administración Pública en general, relación que debe desenvolverse en los términos como está definida en la ley (artículo 5 del Código Municipal anterior, artículo 7 del nuevo Código), que establece la obligación de "coordinación" entre la municipalidades y las instituciones públicas que concurran en el desempeño de sus competencias, para evitar duplicaciones de esfuerzos y contradicciones, sobre todo, porque sólo la coordinación voluntaria es compatible con la autonomía municipal por ser su expresión. En otros términos, la municipalidad está llamada a entrar en relaciones de cooperación con otros entes públicos, y viceversa, dado el carácter concurrente o coincidente -en muchos casos-, de intereses en torno a un asunto concreto. En la doctrina, la coordinación es definida a partir de la existencia de varios centros independientes de acción, cada uno con cometidos y poderes de decisión propios, y eventualmente discrepantes; pese a ello, debe existir una comunidad de fines por materia, pero por concurrencia, en cuanto sea común el objeto receptor de los resultados finales de la actividad y de los actos de cada uno". De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible "concierto" interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros".
Adviértase, por lo demás, que las Municipalidades están obligadas, por imperativo del ordinal 50, de la Constitución Política, a prodigarse en la protección del ambiente (Sentencia N° 2006-7994 de las 8:57 horas de 2 de junio de 2006).”
VI.En cuanto al Área Rectora de Salud. La accionante alega que el 22 de octubre de 2019 remitió al Área Rectora de Salud Curridabat estudios municipales sobre el problema objeto de este proceso; sin embargo, no ha tenido respuesta. Luego de analizar los autos, la Sala tuvo por probado que, efectivamente, la recurrente presentó un documento en esa área rectora, donde indicó: “Adjunto sírvase encontrar Informe Técnico de la Comisión Nacional de Emergencia, (CNE) realizado el 19 de junio 2019, CNEUIAR-INF-0487-20 19, cuyos objetivos indicados son: (…) Es nuestro interés que este documento sea de su conocimiento, en virtud de la gran preocupación por los puntos expuestos que tienen que ver de forma directa con la parte de Medio Ambiente: aguas estancadas, basura, tuberías en mal estado, que en apariencia alguna de ellas podrían transportar aguas negras, entre otros puntos preocupantes e indicados en el citado informe de la CNE.
Todas estas situaciones impactan riesgos de salud para la alta densidad poblacional y de alta vulnerabilidad en las zonas aledañas al Río María Aguilar, específicamente en el tramo de Cipreses hasta aguas abajo del Condominio Mallorca, lo que pone en riesgo la salud de dicha población, donde esta situación, se constituya en signo de alerta, para que se tomen las medidas necesarias, para prevenir futuros desastres, aparte de ampliar criterios técnicos que coadyuven en dar seguridad, calidad de vida a esta zona de alta vulnerabilidad. No omitimos indicar que desde el año 2003, hemos realizado esfuerzos para que Municipalidad de Curridabat intervenga, sin contar a la fecha con respuesta satisfactoria y que elimine los inminentes riesgos para la población interesada. Cordialmente, en espera de su respuesta.” En cuanto a este agravio, la recurrida alega que la accionante no concretó el perjuicio que sufre, pues el informe de la CNE es un abordaje general.
La Sala no pudo tener por probado que el Área Rectora de Salud de Curridabat atendiera de alguna manera el citado escrito de la accionante. Luego de valorar la nota enviada por la accionante, la Sala no extrae de ella una pretensión concreta, dirigida al área rectora recurrida, pues su intención es que “…este documento sea de su conocimiento…”. La vaguedad de tal pretensión no puede genera en la recurrente una expectativa en la atención de la misma. Igualmente, tampoco se establece un actuar concreto exigible en relación con la situación del río María Aguilar. La Sala tampoco puede achacar inacción a esa área rectora de salud, pues ha participado desde 2010 en la iniciativa Corredor Biológico Interurbano Nombre02 y también en la Estrategia Nacional de recuperación de cuencas urbanas 2020-2030, desplegando acciones propias de su competencia. Tales consideraciones llevan a desestimar el reclamo.
VII.Atinente al cumplimiento de las recomendaciones de la CNE y la CGR. La accionante alega que la Municipalidad de Curridabat ha incumplido las recomendaciones de la CNE y la CGR. En cuanto a la CNE, menciona los oficios n.os DL-OF-198-2012 y CNE-UIAR-INF-0487-2019. La Sala nota que el cumplimiento del primero fue conocido mediante sentencia n.° 2018-17706 de las 9:20 horas del 26 de octubre de 2018, dictada en el expediente 18-006757-0007-CO, donde se resolvió:
“Se declara con lugar el recurso, únicamente, en cuanto a la falta de acatamiento de las recomendaciones brindadas por la Comisión Nacional de Emergencias para solucionar el problema que existe por el desbordamiento del Nombre02 y sus consecuencias. Se ordena a Alicia Borja Rodríguez, en calidad de Alcaldesa de la Municipalidad de Curridabat, o a quien en su lugar ocupe ese cargo, que dentro del ámbito de su competencia, adopte las medidas pertinentes para que, dentro del plazo máximo de SEIS MESES contado a partir de la notificación de esta resolución, den solución al problema denunciado, que afecta a los recurrentes (…)”.
Por otro lado, en cuanto al oficio n.° CNE-UIAR-INF-0487-2019, la Sala estableció en la resolución n.° 2019-014352 de las 14:20 horas del 1 de agosto de 2019, emitida también en el expediente 18-006757-0007-CO, que ese informe era un seguimiento del n.° DL-OF-198-2012, que no debía ser conocido por la Sala:
“II.- Finalmente, en relación con el informe técnico No. CNE-UIAR-INF- 0487-2019, suscrito por la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, denominado “Inspección y valoración de situación existente en el tramo de Nombre02 carretera a Cartago, Dirección07”, según informó la autoridad recurrida se trata de un seguimiento del informe DPMINF- 0514-2012, el cual no viene a señalar la existencia de un incumplimiento por parte del municipio recurrido. Asimismo, consta que mediante informe técnico No. MC-GR-0064-07-2019 del 11 de julio de 2019, la Unidad de Gestión de Riesgo del municipio recurrido, indicó a la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, las fechas y lugares donde se han realizado las limpiezas rutinarias y extraordinarias en la zona, en aras de brindar una solución a la problemática alegada, información con la que no contaba dicha Comisión y que corresponde a los trabajos que ha realizado el municipio para dar cumplimiento a referida sentencia.
Así las cosas, al determinarse que dicho informe versa sobre un seguimiento realizado por Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, lo cual no corresponde a hechos nuevos que deban ser conocidos por esta Sala ni que incidan en el cumplimiento de la sentencia 2018- 017706 de las 9:20 horas del 26 de octubre de 2018, en cuanto a este extremo, lo procedente es declarar improcedente la gestión.” (El subrayado es agregado).
Deberá estarse la parte a lo ahí resuelto.
Atinente a las recomendaciones de la CGR, la Sala tuvo por probado que ella emitió el “Informe de auditoría operativa acerca de la gestión del servicio de alcantarillado pluvial en la Municipalidad de Curridabat” (oficio n.° DFOE-DL-IF-00012-2019 del 6 setiembre de 2019). Con respecto al cumplimiento de este informe, la Sala corroboró que, mediante oficio DFOE-SD-0456 del 18 de marzo de 2021, la CGR comunicó a la Municipalidad de Curridabat que había cumplido razonablemente con la disposición 4.6 de ese informe. Luego, por oficio DFOE-SEM-0936 del 5 de octubre de 2021, la CGR señaló que la municipalidad había cumplido con el punto 4.4 del citado informe. Al analizar el informe, el único punto que aparentemente no ha sido cumplido es el 4.5., donde se indica al alcalde de Curridabat:
“Elaborar un estudio técnico que permita conocer la situación actual del sistema de alcantarillado pluvial existente, el cual permita disponer de datos y criterios técnicos tales como capacidad hidráulica de los componentes del sistema, riesgos hidrológicos, vulnerabilidades, materiales y estado de la infraestructura, antigüedad, vida útil, entre otros, para posteriormente determinar las necesidades de mantenimiento e inversión de alcantarillado pluvial. Una vez finalizado dicho estudio, definir una cartera de proyectos a mediano y largo plazo conforme a las necesidades de mantenimiento e inversión identificados en el estudio técnico (ver párrafos del 2.20 al 2.31). Para ello, se deberá presentar al Área de Seguimiento de Disposiciones de la Contraloría General de la República lo siguiente: i. Un oficio en el cual se indique la elaboración del estudio técnico de acuerdo con los términos dispuestos, a más tardar el 30 de junio de 2020. ii.
Un oficio en el que se indique la elaboración de la cartera de proyectos, a más tardar el 01 de octubre de 2020.” Ahora bien, la Sala determina que este Tribunal no es una instancia fiscalizadora del cumplimiento de las obligaciones de cada institución. Su labor es la tutela de derechos fundamentales. Así, el cumplimiento de una obligación institucional podría ser amparable cuando esté directamente relacionado con un derecho fundamental. En este caso, la omisión de elaborar un informe técnico para luego definir proyectos a mediano y largo plazo dista de ser una lesión o amenaza real a derechos fundamentales. Por ese motivo, se desestima el reclamo.
VIII.En cuanto a la atención de los oficios MC-DGV-289-05-2021, MC-ALC-0614-08-2021 y MC-ALC-0869-10-2021 por parte del MOPT. La parte accionante considera que el MOPT ha lesionado los numerales 27 y 30 de la Constitución Política, toda vez que no ha atendido los oficios MC-DGV-289-05-2021, MC-ALC-0614-08-2021 y MC-ALC-0869-10-2021 de la Municipalidad de Curridabat. Al respecto, la Sala tuvo por probado que, por oficio DGV-289-05-2021 del 5 de mayo de 2021, el alcalde de Curridabat puso al ministro accionado en conocimiento del problema de desbordamiento del río María Aguilar. Solicitó sus buenos oficios para la intervención de mantenimiento eficiente que permitiera mejorar la capacidad hidráulica del puente sobre la Dirección02. En atención a este oficio, el 10 de junio de 2021, funcionarios municipales y del MOPT inspeccionaron el lugar de los desbordamientos. Luego, el subdirector de la Dirección de Obras Fluviales del MOPT rindió informe al director de esa dirección con respecto a la inspección y emitió recomendaciones (oficio DVOP-DOF-2021-0627 del 18 de junio de 2021).
Tales recomendaciones fueron comunicadas a la municipalidad accionada mediante correo del 21 de junio de 2021. Posteriormente, por medio del oficio MC-ALC-0614-08-2021 del 11 de agosto de 2021, dirigido al ministro recurrido, el alcalde de Curridabat dio seguimiento al oficio DGV-289-05-2021. Comunicó que la Dirección de Gestión Vial y el Departamento de Gestión del Riesgo de la municipalidad realizaron una inspección con ingenieros de la Dirección de Obras Fluviales. Solicitó el accionar que daría el MOPT e hizo ver que había una comunidad vulnerable al riesgo de inundaciones. Luego, por oficio MC-ALC-0869-10-2021 del 26 de octubre de 2021, el alcalde de Curridabat solicitó al ministro recurrido la valoración e intervención de los sitios donde el Nombre02 causa inundaciones en rutas nacionales. En atención a este oficio, el director de la Dirección de Obras Fluviales remitió el oficio DVOP-DOF-2021-1257 del 3 de noviembre de 2021 al ministro recurrido, oficio que fue trasladado a la Municipalidad de Curridabat por correo del 4 de noviembre de 2021.
La Sala explica a la recurrente que los oficios antes señalados son parte de la coordinación interinstitucional, tendente a la atención del problema de fondo (lo que se verá en el considerando siguiente). En ese tanto, no se conceptualizan como peticiones o gestiones que se circunscriban en el ámbito de protección de los numerales 27 y 30 constitucionales. En consecuencia, se desestima el reclamo.
IX.Con respecto al problema de desbordamiento del Nombre02 en el sector de Curridabat. La parte accionante manifiesta que el Nombre02 se desbordó el 23 de setiembre de 2021, lo que afectó a los vecinos, incluyendo al condominio Mallorca. Relata que todos los años ocurren eventos similares. Reclama que las acciones de las autoridades son insuficientes o meramente correctiva. Luego de analizar los autos, la Sala tuvo como hecho incontrovertido que, desde hace unos 10 años, el Nombre02 se desborda cuando hay episodios de lluvias fuertes en la zona de Curridabat, donde está el puente de la ruta nacional 2 y el puente de la ruta municipal hacia Cipreses. Cuando eso ocurre, el desbordamiento afecta a los habitantes del condominio Mallorca. Uno de esos eventos ocurrió el 23 de setiembre de 2021, tal como se reclama. La Sala corroboró que la Municipalidad de Curridabat ha emprendido múltiples acciones para solucionar el problema y velar por los intereses locales.
En ese sentido destaca que, durante 2021 y hasta la fecha de rendición del informe, la municipalidad había intervenido en 22 oportunidades el Nombre02 con labores de limpieza de alcantarillado pluvial, inspección, poda, retiro de residuos, etc. Asimismo, la municipalidad tiene un proyecto de instalación de una red de estaciones meteorológicas que permitirán medir la intensidad de las lluvias, estimar si habrá un desbordamiento del río y emitir una alerta. La última fase de instalación del proyecto estaba programada para terminar en 2021. De gran importancia también es la gestión municipal para un nuevo puente en la ruta cantonal hacia Cipreses. El proyecto fue aprobado por el CFIA, MINAE y SETENA, y los recursos para su construcción fueron incorporados en el POA-2022. La obra incluye intervención en el cauce, lo que ampliará la capacidad hidráulica 100 metros aguas arriba y 75 metros aguas abajo.
Si bien la Sala reconoce estos esfuerzos, no menos cierto es que el problema de desbordamiento e inundación en la zona persiste. Ya en 2018, la Sala tuvo noticia de la situación, según se analizó en la citada sentencia n.° 2018-17706. A pesar del transcurso de los años no se encuentra en el expediente una línea clara que permita prever que se resolverá el problema en un plazo razonable. El principal proyecto es el nuevo puente por la ruta a Cipreses, antes mencionado; no obstante, no se han definido mayores labores a emprender río abajo, en el puente de la Dirección08 y la zona del condominio de la amparada. Es claro que la Sala no puede efectuar valoraciones técnicas y decantarse por un proyecto o solución específica, no solo porque tales aspectos escapan de su competencia, sino porque existe discrepancia entre las partes o los informes técnicos. Así, por ejemplo, en ocasiones se recomienda dragar el río; en otras se indica que sería contraproducente y poco efectivo.
La Sala también hace hincapié en la responsabilidad de la municipalidad, pues sus obligaciones se extienden más allá de la afectación vial y abarcar asimismo el ordenamiento territorial, de manera que el crecimiento urbano se dé en el marco de un ambiente sano y ecológicamente equilibrado. Tal obligación comprende la planificación, el otorgamiento de permisos, la fiscalización de obras, la vigilancia y conservación de zonas protegidas locales (ríos y sus márgenes) y la coordinación con otras municipalidad y entidades estatales (considerando V). En criterio de la Sala, el problema acusado por la recurrente se circunscribe en ese deber de coordinar y velar por los intereses locales y nacionales. Se extrae de los hechos probados, en especial lo que se detallaron en el considerando anterior, que ha habido cierta coordinación con el MOPT para abordar el problema. Sin embargo, no se observa que se concretara un plan de acción y, mucho menos, que él fuera implementado.
Ante este panorama corresponde a la Sala brindar certeza a los tutelados con respecto al restablecimiento de sus derechos, girando para ello la orden atinente. La Sala reconoce que la magnitud del problema imposibilita que la solución sea inmediata; de ahí la amplitud del plazo otorgado, lo que se hace con reserva expresa de las potestades de esta Sala para velar por la ejecución de lo ordenado (artículo 56 de la Ley de la Jurisdicción Constitucional). En virtud de lo anterior, se declara con lugar este extremo en los términos expuestos en la parte dispositiva de esta sentencia.
X.Con respecto a la sentencia n.° 2018-17706 de las 9:20 horas del 26 de octubre de 2018. Por último, se reclama el incumplimiento de la sentencia n.° 2018-17706 de esta Sala. La parte interesada deberá plantear y fundamentar la gestión respectiva en el expediente correspondiente, si a bien lo tiene.
XI.Nota del Magistrado Salazar Alvarado. En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que está de por medio la tutela de la vida, salud pública e integridad física de los recurrentes, de los habitantes del Condominio Mallorca en Curridabat, debido a las inundaciones que sufren sus viviendas por desbordamiento del río María Aguilar, lo que provoca que la corriente de agua arrastre basura de todo tipo, aguas negras, con daño evidente también a la propiedad.
XII.Voto salvado parcial respecto a la parte dispositiva de esta sentencia de la Magistrada Garro Vargas. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero parcialmente sobre dónde residenciar la fase de ejecución del asunto, específicamente en cuanto a las acciones que se estipulen para solucionar el problema de desbordamiento e inundación del Nombre02 en la zona objeto de este proceso, lo anterior debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso, en los términos señalados en el considerando IX de esta sentencia. Se ordena a Jimmy Cruz Jiménez, Randall Rodríguez Araya y Óscar Mora Altamirano, por su orden alcalde, director de gestión vial y presidente del Concejo, todos de la Municipalidad de Curridabat, y a Rodolfo Méndez Mata, en su condición de ministro de Obras Públicas y Transportes, o a quienes ejerzan esos cargos, que, en aplicación de la coordinación interinstitucional, giren las órdenes necesarias, en el ámbito de sus competencias, para que ambas instancias elaboren en conjunto un plan de acción que solucione el problema de desbordamiento e inundación del Nombre02 en la zona objeto de este proceso. Se otorga a los recurridos el plazo de SEIS MESES, contado a partir de la notificación de esta sentencia, para la elaboración del citado plan, y el plazo adicional de TREINTA Y SEIS MESES para su implementación.
Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de Curridabat al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto al cumplimiento de las recomendaciones de la Comisión Nacional de Emergencia, estese a lo resuelto en las resoluciones n.os 2018-17706 de las 9:20 horas del 26 de octubre de 2018 y 2019-014352 de las 14:20 horas del 1 de agosto de 2019.
En lo demás, se declara sin lugar el recurso. El Magistrado Salazar Alvarado pone nota. La Magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Notifíquese.
