Document Review Decision No. 2022003192 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine thirty on once de febrero de dos mil veintidos.
Writ of amparo (recurso de amparo) proceeding under expediente n.o 21-023717-0007-CO, filed by MANUEL ÁNGEL MORERA PIEDRA, identity card CED01, against the MUNICIPALIDAD DE ALAJUELA.
Facts:
With regard to the commercial activities on the property, it is important to emphasize that, for several years, activities such as automotive repair shops, a tamale factory, neighborhood grocery stores, etc., have operated at the site. Once they are shut down, the seals are broken because they are unable to obtain a business license (patente), and once they are ordered by the court to comply as part of the proceedings brought against them, the activities are discontinued by the same (sic) owners before they are tried. Currently, two activities are being conducted at the site without the corresponding municipal business license: a cabinetmaking workshop, which was notified by means of notice slip N° 013013, and a metal articles manufacturing workshop, notified by means of notice slip N° 013012. Once the 8-business-day period granted under the Ley de Patentes of this Municipality has expired, the corresponding closure will be carried out and each case will be followed up.” Finally, they state: “In light of the petitioner’s statements concerning the Municipal Council resolution cited above, it is extremely important to mention that this Municipality, through the Public Investment Works Department, intervened at the site and, on the first occasion, installed a prefabricated wall, which was removed by the residents themselves.
On two subsequent occasions, welded wire mesh was installed at the site in compliance with what was (sic) stipulated by the Honorable Municipal Council. In view of all the foregoing, the Municipalidad de Alajuela has undertaken numerous actions over the years. Municipal Council resolutions have even been implemented and works have been carried out at the site, aimed at regulating the situation in the most appropriate manner, considering that the settlement built on that property does not have the corresponding permits. Nevertheless, over time, extensive municipal actions have been undertaken to address each of the matters identified by the protected party, and, more recently, the corresponding official notices were once again served by the Fiscal and Urban Control Process. These will receive the appropriate follow-up in compliance with the statutory deadlines. With regard to the participation of the Municipal Council, resolutions consistent with the law have been adopted and implemented by the Administration, considering that, in any event, the matter falls outside the powers of the Municipal Council because it concerns administrative issues whose handling properly falls to the Municipal Mayor, as established in articles 13, 14 and 17 of the Código Municipal.
Accordingly, this constitutional protection proceeding (amparo) against the President of the Municipal Council makes (sic) no sense whatsoever. As for the other officials, the proceeding is likewise inadmissible because, as explained at length, most of the actions pertain to other areas and not to the area identified by the petitioner; the proceeding against them is therefore inadmissible. However, it should be noted that, in view of the foregoing and the actions undertaken by this Municipality, the proceeding as a whole has no basis, since Mr. Morera Piedra’s constitutional rights have not been violated, as the Municipality has taken all pertinent actions in an effort to regulate the situation at the site (…)”.

Considering:
The petitioner states that he is a resident of Alajuela, Desamparados, Dirección03. He indicates that Dirección01 is located at that site, under Alajuela property registration number -, with cadastral plan number, and that its designated use is land for construction. Likewise, behind that lot is the Dirección04 property, which borders Residencial La Cataluña. He alleges that Dirección01 is currently used as a right of way and public street, and is therefore being put to a use other than that authorized by the Plan Regulador. He alleges that industrial commercial activities are conducted and structures have been built on the aforementioned properties, all illegally, because they lack the corresponding municipal permits, authorizations, and licenses. He alleges that the illegal activities conducted at the site generate noise, water, and environmental pollution. He adds that, because the activities and structures are illegal, they do not receive garbage collection service, and garbage therefore accumulates in the residential area; he further states that there are no stormwater or sanitary sewers, sidewalks, gutters, or curbs at the site, so muddy water, gravel, and garbage flow along the public roadway of Residencial La Giralda.
He emphasizes that the illegal activities and construction are taking place in this area, which is an “absolute water-recharge protection zone and its flow area (aquifer)”; nevertheless, there are septic tanks that contaminate the aquifers, and other structures have illegal wells that draw water from the aquifer. He adds that more than 20 ICE electrical services have been installed on the property for the illegal activities and structures; these are crowded together and in poor condition, creating a fire hazard. He also states that the property is not properly enclosed, fenced, and kept clean, as required by Article 75 of the Código Municipal. He maintains that, because of the situation described, residents of the housing development have filed complaints with the municipality since 2009; however, no solution has been provided.
The following facts are deemed duly established and relevant to the disposition of this matter, either because they have been proven or because the respondent authority failed to address them, as directed in the initial order:
The result is the image of a Local Government lacking the necessary authority to enforce its hierarchy within the municipal organization and with respect to residents, since the Código Municipal clearly establishes the obligations of both residents and local governments, and failure to fulfill those obligations could give rise to claims against the responsible municipal officials jointly and severally with the property owners (…) With respect to the property behind lot 6T, this Auditoría Interna determined that buildings exist that apparently lacked municipal permits, given that, according to the zoning map, homes and businesses may not be built in that area because most of it is considered an absolute spring-recharge zone (zona de recarga absoluta de nacientes). Likewise, there was no evidence of inspections by the Proceso de Control Fiscal y Urbano, except with respect to the auto repair shop, which, despite the notices and legal proceedings initiated by this Institución, continues operating without the respective business license (patente comercial).
In addition to the property owners’ potential noncompliance with the Plan Regular Urbano and the Ley de Construcciones, this has resulted in disorderly urban growth lacking basic municipal services such as solid-waste collection and stormwater drainage, which in turn affects residents of housing developments such as La Giralda in matters of urban planning, health, and appearance.”. (Documentary evidence).
An effort should be undertaken to regularize and correct these irregularities, because they are causing health problems as well as improper management of stormwater and sewage, among other issues arising from the lack of infrastructure resulting from the illegality and failure to comply with the regulations in force (…)”. (Report by the respondent authority and documentary evidence).
It is therefore appropriate to note that, from a technical standpoint, it would not have made sense to install piping in anticipation of the flow generated on the aforementioned property. 3. Due to the foregoing, we can state that when rainfall of moderate intensity (or greater) occurs, the stormwater system becomes overwhelmed by the increased flow it must handle. 4. It is unknown how the homes built on the property under real property folio N° 2-014851-000 dispose of stormwater, because no information is available due to the manner in which the buildings were constructed. Therefore, it cannot be stated that all water generated on that property is discharged through Dirección01 of Urbanización La Giralda, but we can state that a considerable flow is discharged through the lot in question, overwhelming the development’s stormwater system.”. (Report by the respondent authority and documentary evidence).
With regard to the reported irregularities, the personnel of Control Fiscal y Urbano must follow up and request the corresponding documents authorizing both the structures and the commercial activities located at the site”. (Report by the respondent authority and documentary evidence).
Pursuant to reinspection request 24865-2017 dated 14 de noviembre de 2017, the site was visited and it was verified (sic) that they had performed the requested work. It is important to clarify that, to date, the Departamento de Deberes de los Munícipes has not received (sic) any new complaints; nevertheless, a new inspection of the indicated area was conducted on 03 de diciembre del 2021, and it was verified that the fence had been damaged (…) Accordingly, this office will issue new notices for property 2-280191—interests 001 through 008. With respect to commercial activities conducted without a permit and its use as a thoroughfare and public street, this department lacks jurisdiction.” (Report of the respondent authority and documentary evidence).
They are now undergoing the ordinary notification procedure established in Articles 93 and 94 of the Construction Regulations. The following notices have been issued for works lacking construction permits: 179-2021, 95-2020, 128-2019, 451-2017, 388-2017, 387-2017, 94-2017, 73-2017, 130-2016, 196-2016, 139-2016, 136-2016, 137-2016, 138-2016, 129-2016, 54-2016, 55-2016, among others. During the site inspection, it was determined that the dwellings on the aforementioned property already have potable-water service. Regarding commercial activities on the property, it is important to emphasize that, for several years, businesses such as auto-repair shops, a tamale factory, neighborhood grocery stores, etc., have operated at the site. Once they are closed down, the seals are broken because they cannot obtain a business license (patente), and once the court admonishes them in the proceedings brought against them, the activities are discontinued by their own (sic) owners before they are adjudicated.
Two activities are currently being conducted at the site without the corresponding municipal business license: a cabinetmaking shop, which was notified by notice N° 013013, and a metal-article fabrication shop, notified by notice N° 013012. Once the granted period of 8 business days provided by this Municipality’s Business License Law has expired, each establishment will be closed down and each case will be followed up.” (Report of the respondent authority and documentary evidence).
In the case at hand, the appellant states that he is a resident of Alajuela, Desamparados, Dirección03. He indicates that Dirección01 is located at that site, registered in Alajuela-, with cadastral survey plan number, and designated as land for construction. Likewise, property Dirección04 is located behind that lot and borders Residencial La Cataluña. He alleges that Dirección01 is currently used as a thoroughfare and public street and is therefore being put to a use different from that authorized by the Plan Regulador. He claims that industrial commercial activities are conducted and structures have been built on the aforementioned properties, all illegally because they lack the corresponding municipal permits, authorizations, and licenses. He claims that the illegal activities conducted at the site cause noise, water, and environmental pollution. He adds that, because the activities and structures are illegal, they do not receive garbage-collection service, causing garbage to accumulate in the residential area.
He further states that there are no stormwater or sanitary sewers and that the site lacks sidewalks, drainage ditches, and curbs, causing muddy water, gravel, and garbage to flow along the public roadway of Residencial La Giralda. He emphasizes that the illegal activities and construction take place in an area designated for “absolute protection of hydrological recharge and its flow area (aquifer)”; nevertheless, septic tanks pollute the aquifers, and other structures have illegal wells that extract water from the aquifer. He adds that more than 20 ICE electrical-service connections have been installed on the property for the illegal activities and structures; they are crowded together and in poor condition, creating a fire hazard. He also states that the property is not properly enclosed, fenced, and cleaned, as required by Article 75 of the Municipal Code. He maintains that, because of the situation described, residents of the development have filed complaints with the municipality since 2009; however, no solution has been provided.
The review of the case record establishes that the Internal Audit Office of the Municipalidad de Alajuela, through report 6-2015, concluded: “Based on the results obtained in the investigation conducted, this Internal Audit Office concludes that, regarding the complaint filed by residents of Urbanización La Giralda concerning Dirección01, of which the Administration became aware in 2007, as of the date of this study no solution has been provided; on the contrary, the situation may have worsened, given the conditions of the property beyond Dirección01, the large number of electricity meters within an area of 150 m2 adjacent to the homes in residencial La Giralda, and the constant traffic along a ‘road’ that is nothing more than a residential lot that remains vacant to date. The foregoing is without prejudice to the file compiled by this Office containing the documentation processed internally and externally in this regard (official letters, formal warning records, notices, directives from the Municipal Mayor’s Office, among others), which did not materialize into concrete actions that would put an end to the situation involving Dirección01.
The consequence is the image of a Local Government lacking the necessary authority to enforce its hierarchy within the municipal organization and with respect to municipal residents, since the Código Municipal clearly establishes the obligations of both municipal residents and local governments, the omission of which could result in claims against the responsible municipal officials, jointly and severally with the property owners (…) Regarding the property beyond Dirección01, this Internal Audit Office determined that there are buildings that apparently did not have municipal permits, since, according to the zoning map, the construction of housing and commercial premises is not permitted in that area because most of it is classified as an absolute spring (naciente) recharge zone. Likewise, no inspection work by the Tax and Urban Control Process was evidenced, except with respect to the automotive repair shop, which, despite the notices and legal proceedings initiated by this Institution, continues operating without the corresponding business license (patente comercial).
In addition to the potential violation of the Urban Regulatory Plan and the Ley de Construcciones by the property owners, the foregoing has resulted in disorderly urban growth lacking basic municipal services such as solid-waste collection and stormwater drainage, which in turn affects residents of developments such as La Giralda in matters of urban planning, health, and public appearance.” Through official letter No. MA-SGV-914-202103 of 3 de diciembre de 2021, the acting coordinator of the Road Management Subprocess of the Municipalidad de Alajuela stated: “Dirección01, corresponding to property number 280191, is not a de facto public road; it is privately owned property registered in the names of private individuals. This Subprocess is not responsible for issuing an opinion regarding the buildings, residences, and commercial activities conducted on property #14824.” The director of the Infrastructure Planning and Construction Process of the respondent municipality stated in official letter No. MA-PPCI-0797-2021 of 3 de diciembre de 2021: “(…) The referenced parcel is indeed a building lot, specifically lot 6-T of urbanización La Giralda, described in cadastral plan A-159655-1993 and identified by property number 0280191-000, with 7,50 meters of frontage and designated for construction rather than access, because it neither satisfies the minimum road-width dimensions nor has infrastructure, and it is not depicted as such on the official map, namely the general cadastral mosaic of Urbanización La Giralda approved by INVU and the Concejo Municipal.
For that reason, efforts have been undertaken to notify the parties and regularize this activity, which is clearly anomalous and illegal at the municipal level. The situation exceeds the authority of the Infrastructure Planning and Construction Process and must be coordinated with the Tax and Urban Control Process, together with the Policía Municipal and other government authorities such as the Ministerio de Salud, MINAE, and IMAS. An effort should be undertaken to regularize and correct these anomalies, since they are causing health problems, as well as improper management of stormwater and sewage, among other issues resulting from the lack of infrastructure arising from the illegality and failure to comply with the regulations in force (…)” Through official letter No. MA-AAP-0974-2021 of 3 de diciembre de 2021, Eng. Lawrence Chacón Soto, Stormwater Drainage Coordinator of the Municipalidad de Alajuela, stated: “(…) 1.
Regarding the management of stormwater from the hamlet or lot subdivision (lotificación) located southeast of block T of urbanización La Giralda, it did not at the time receive any approval or authorization from the Stormwater Drainage Activity; therefore, the manner in which the stormwater assessments were performed for authorization of the urban development on the parent property (folio real N° 2-014824-000) is unknown. 2. The stormwater design for urbanización La Giralda does not account for runoff from the property on which the urban development was carried out, because the site plans do not establish any type of water passage or easement (servidumbre) from the property with folio real N° 2-014851 to the stormwater system of urbanización La Giralda; accordingly, it is appropriate to note that, from a technical standpoint, it would make no sense to have provided piping for the flow generated on the aforementioned property. 3.
In light of the foregoing, we can state that when rainfall of moderate intensity (or greater) occurs, the stormwater system fails due to the increased flow it must handle. 4. It is unknown how the residences built on the property with folio real N° 2-014851-000 dispose of stormwater, since no information is available due to the manner in which the buildings were constructed. It therefore cannot be stated that all water generated on that property is discharged through Dirección01 of urbanización La Giralda, but we can state that a considerable flow is discharged through the lot in question, saturating the development’s stormwater system.” The coordinator of the Construction Control Activity of the respondent municipality stated in official letter No. MA-ACC-4828-2021 of 7 de diciembre de 2021: “In response to official letter No MA-PSJ-2433-20211, in which you request that we submit a report on the situation raised by Mr.
Manuel Ángel Morera Piedra concerning the reported use of lot 6-T, as shown on the cadastral plan and located at Dirección03, I hereby advise that a review was conducted to determine whether any land-use authorization (uso de suelo) or building-permit applications had been filed for the reported lot. It was verified that no such applications exist for the property in question; consequently, the lot remains undeveloped. After reviewing the information provided concerning the registered property adjoining lot 6-T, it was likewise verified that it has no applications for land-use authorization, utility availability and endorsement (visado), or building line (alineamiento); furthermore, no building-permit applications related to the property at issue could be found. See the PDF record of proceedings from the Sistema Visión2020. Regarding the reported irregularities, the Tax and Urban Control personnel must follow up and request the corresponding documents authorizing both the buildings and the commercial activities at the site.” Through official letter No. MA-ADM-1681-2021 of 6 de diciembre de 2021, the acting coordinator of the Municipal Residents’ Duties Activity explained: “(…) Regarding property 2-280191- rights 001 al 008, cadastral plan A-0159655-1993, located in the district of Desamparados, La Giralda, lot 6-T, by means of notification records 1371-2010 of 03 de diciembre del 2010, the registered owners were ordered to clean and fence vacant lots and to construct and maintain sidewalks.
They were granted 5 days to complete the required work pursuant to Article 6(a) of the Regulations implementing Article 75 of the Código Municipal. Within the scope of this office’s authority, once the allotted period had expired, an inspection was conducted and it was verified that the required work had not been completed. Accordingly, a fine for failure to perform the duties set forth in subsections b) Fence and clean vacant lots and D) Construct and maintain sidewalks was imposed on the aforementioned property. Pursuant to reinspection request 24865-2017 of 14 de noviembre de 2017, the site was visited and it was verified (sic) that the required work had been completed. It is important to clarify that, to date, the Municipal Residents’ Duties Department has not received (sic) any new complaints; nevertheless, a new inspection was conducted in the identified area on 03 de diciembre del 2021, and it was verified that the fence had been damaged (…) Accordingly, this office will issue new notification records for property 2-280191-rights 001 al 008.
This department has no jurisdiction over unauthorized commercial activities or the use of the property as a passageway and public street.” Through official letter No. MA-AAAS-677-2021, the coordinator of the Aqueduct and Sanitation Administration Activity of the Municipalidad de Alajuela stated: “(…) ● According to an inspection of property N° 280191-000, as shown on cadastral plan A-0159655-1993, conducted by municipal employee Mario Bolaños, it was determined that the property is a vacant lot and has no potable-water connection. ● Regarding property N° 14828-000, I hereby advise that an inspection likewise conducted by Mr. Bolaños determined that 26 municipal potable-water meters have been installed and are duly registered in the Sistema Tributario de Cobro. It was also determined that a hand-dug potable-water well has been constructed on this property, which is administered by a third party and supplies 18 apartments, 8 residences, and an auto body and paint shop.
It should be noted that tests were conducted on the municipal potable-water distribution network and no irregular connection was found.” Through official letter No. MA-AGIRS-1557-2021, the coordinator of the Comprehensive Solid Waste Management Activity of the respondent municipality stated: “(…) I hereby report the following, based on the observations of our inspector, Mr. Julio Acuña Salas, during a visit conducted today, lunes 06 de diciembre del año en curso, at the indicated location: 1- The inspection of Property N° 014824 verified that it does not conduct any waste-generating activity and therefore is not charged for the service. It was verified at that time that the area was clean and that no waste had accumulated on the property or on the public road. 2- Property N° 280191 has a street that is officially part of the cantonal road network, as resolved by the Concejo Municipal (see official letter MA-SCM-246-2020).
Door-to-door ordinary solid-waste management service is provided there, as required by the legislation in force. 3- As part of this office’s ordinary duties, the charges applicable to the owners of the properties located there will be reviewed and updated according to the quantity and type of waste-generating activity they conduct, as provided by the municipal regulations.” By official letter (oficio) n.° MA-PCFU-2071-2021 of 3 de diciembre de 2021, the official in charge of the Fiscal and Urban Control Process of the Municipalidad de Alajuela stated: “As is apparent from the amparo proceeding (amparo), several actions have already been taken with respect to the property recorded under real property folio (finca folio real) N° 2-14824-000, which currently consists of 64 ownership interests, including interests held by corporations. As the petitioner indeed indicates, a lot forming part of Residencial La Giralda is used as a means of access to the aforementioned property; a welded-wire-mesh gate and an area for the installation of electricity meters belonging to the company I.C.E were placed on that lot, together with pedestrian access, and a sidewalk was built to provide access to the property.
There are currently several dwellings on the property recorded under real property folio N° 2-14824-000, including apartments, which were built without building permits; several closure proceedings (procesos de clausura) were carried out while they were under construction, and the ordinary notification procedure established in Articles 93 and 94 of the Reglamento de Construcciones is currently being conducted in relation to them. The following reports have been issued for works lacking building permits: 179-2021, 95-2020, 128-2019, 451-2017, 388-2017, 387-2017, 94-2017, 73-2017, 130-2016, 196-2016, 139-2016, 136-2016, 137-2016, 138-2016, 129-2016, 54-2016, 55-2016, among others. During the site inspection, it was established that the dwellings on the property in question already have potable water service. Regarding commercial activities on the property, it is important to emphasize that activities such as auto repair shops, a tamale factory, neighborhood grocery stores, etc., have operated at the site for several years.
Once these businesses are closed, they break the official seals because they are unable to obtain a business license (patente), and after being formally warned by the court in the proceedings brought against them, the businesses are removed by the owners themselves prior to trial. Two activities are currently being conducted at the site without the corresponding municipal business license (patente municipal): a cabinetmaking workshop, which was notified by means of notice form N° 013013, and a metal-article manufacturing workshop, notified by means of form N° 013012. Once the granted period of 8 business days, as provided by the Ley de Patentes of this Municipality, has expired, the corresponding closure will be carried out and each case will be followed up.” The mayor and the head of the Road Management Department, both of the Municipalidad de Alajuela, were notified of the order initiating these proceedings (resolución de curso) on 2 de diciembre de 2021.
On 3 de diciembre de 2021, the respondent municipality issued form n.° 013012, which stated: “Manufacture of metal articles (…) Nombre01 (…) DURING AN INSPECTION OF THE ESTABLISHMENT, THE FOLLOWING WAS VERIFIED: a. It does not have a municipal license (Art. 1 Ley 8236) X (…) You are hereby warned that, within 08 business days, you must bring the commercial establishment into compliance; otherwise, the premises will be closed and/or the liquor will be seized, pursuant to Articles 1 et seq. of Ley 8236 del Impuestos Municipales del Cantón Central de Alajuela, Articles 79, 81 bis and 83 of the Código Municipal, and the Ley de Licores (…) Property 14824.” On 3 de diciembre de 2021, the respondent municipality issued form n.° 013013, which stated: “Cabinetmaking workshop (…) Nombre02 (…) commercial activity (…) DURING AN INSPECTION OF THE ESTABLISHMENT, THE FOLLOWING WAS VERIFIED: a. It does not have a municipal license (Art. 1 Ley 8236) X (…) You are hereby warned that, within 08 business days, you must bring the commercial establishment into compliance; otherwise, the premises will be closed and/or the liquor will be seized, pursuant to Articles 1 et seq. of Ley 8236 del Impuestos Municipales del Cantón Central de Alajuela, Articles 79, 81 bis and 83 of the Código Municipal, and the Ley de Licores (…) Property 14824.” The president of the Concejo Municipal de Alajuela was notified of the order initiating these proceedings on 7 de diciembre de 2021.
In this regard, it is pertinent to recall the ruling of this Court in judgment n.° 2019021889 at 9:45 a.m. on 8 de noviembre de 2019:
II.Subject matter of the appeal. The petitioners consider that their fundamental rights have been violated because construction has been carried out without municipal permits in the Cerros de la Carpintera, which are protected by executive decree n.º 6112-A-MAG. Those structures fail to meet minimum engineering requirements and harm the environment because they are located in a buffer zone (zona de amortiguamiento), which also creates landslide risks and endangers human lives. They state that on 13 de junio de 2019 they submitted requests concerning the matter to the Alcalde de la Unión; however, the respondent has taken no concrete action to address and respond to their complaints (…)
The respondent is reminded that this Court has held that the right to a healthy and balanced environment (derecho a un ambiente sano y equilibrado) requires the State to ensure adequate protection of the environment, that is, to take the measures necessary to prevent alterations caused by human activity from harming the environment. Accordingly, where there is a risk of serious or irreversible environmental harm—or well-founded doubt in that regard—the guiding principles of Environmental Law (principios rectores del Derecho al Ambiente) require preventive or precautionary measures to ensure that such harm does not occur or that the activity in question is postponed, because if the harmful biological and social consequences were to occur, an ex post facto decision would be ineffective and would have merely moral significance. In this connection, specialized legal scholarship has stated that the preventive principle (principio preventivo) requires that, when there is certainty regarding possible environmental harm, the harmful activity must be prohibited, limited, or made subject to compliance with certain requirements.
In general, this principle applies when risks have been clearly defined and identified as at least probable. It may be applied when there are no technical reports or administrative permits guaranteeing the sustainability of an activity, but sufficient elements exist to foresee potential adverse impacts. By contrast, the precautionary principle (principio precautorio) concerns cases in which, pursuant to principle 15 of the Rio Declaration, scientific certainty is lacking as to the risks and impacts of a particular activity. In general, the difference between the preventive and precautionary principles is said to lie in the level of knowledge and certainty concerning the risks generated by an activity or project. The precautionary principle applies only where such a state of uncertainty exists as a result of particular scientific information, technical studies, etc., that are available or have been conducted.
Thus, the Costa Rican State is required to safeguard the environment and adopt measures guaranteeing its effective defense and preservation. Constitutional Law (Derecho a la Constitución) requires the use of all available means—whether legal or factual—to preserve the environment. In environmental matters, both the Administration and the general public have an obligation to ensure its protection; consequently, an official may not merely declare a lack of jurisdiction, much less fail to perform their duties of oversight and restoration of the legal order. Article 50 of the Constitution requires the State and other public institutions to intervene actively in environmental protection (see judgment number 2011-010889 at 15:22 on 16 de agosto del 2011). In application of those principles, and whenever appropriate, the Administration must refrain from authorizing, approving, or permitting any new application or application for modification; suspend those that are pending until the uncertainty has been resolved; and, concurrently, adopt all measures aimed at environmental protection and preservation in order to guarantee the right to a healthy and ecologically balanced environment.
In the case under review (sub examine), the respondent’s omission, as alleged by the petitioners and verified by this Court, is unacceptable, considering that the municipality bears primary responsibility for addressing problems in its locality, since the problem described arose from the failure to implement the necessary safeguards and controls before the authorized construction took place. These duties have been defined by this Court in its case law:
“On the protection of local interests under Article 169 of the Political Constitution. On other occasions, this Chamber has stated that this article provides that the administration of local interests and services in each canton shall be entrusted to the Municipal Government. Local interests and services have been defined by the Chamber as indeterminate legal concepts (conceptos jurídicos indeterminados), whose precise content for application to specific cases is not established by law; it is therefore necessary for the person responsible for applying them to resort to evaluative and experiential criteria in order to determine their content (see, in this regard, decision Nº 2007-002402). Although the Municipal Government bears general responsibility for protecting these local interests and services, it may distribute its tasks among different officials in order to identify the most effective means of protecting those interests; that is, the Municipal Government, including the Mayor and municipal councilors, has at its disposal an entire body of officials empowered to make a series of decisions for the purpose of dividing functions and tasks, reducing workloads, and, above all, applying specialization criteria, since some officials are more technically and academically qualified than others to make certain decisions” (see judgments number 2008-001604 and 2015-11089) “VII.- The role of municipalities in environmental matters.
In accordance with the foregoing, municipalities, as integral components of the State as a whole, bear a substantial degree of environmental responsibility within the scope of their powers and obligations, whether by directly approving permits or licenses that require prior compliance with requirements demonstrating proper environmental management before other public authorities, or by conducting regular inspections and referring hazardous situations to the authorities with greater powers of intervention. It has already been established that local governments are subject to a duty of coordination and prevention in environmental matters within their territorial jurisdiction, from which it follows that municipalities are indeed important actors in the task of environmental protection. The power of local governments to establish their own land-use planning (ordenación territorial) through regulatory plans (planes reguladores) is beyond dispute; however, the existence of such plans—which, for the most part, lack planning provisions addressing a healthy and ecologically balanced environment—does not render protective environmental legislation inapplicable.
On the contrary, the Chamber considers that, without infringing the constitutional principle of municipal autonomy, every regulatory plan must, as a fundamental requirement and before its approval and implementation, undergo an environmental impact assessment (examen del impacto ambiental) from the perspective established by Article 50 of the Constitution, so that land-use planning and its various regimes are compatible with the scope of the superior rule. This is particularly important because that provision establishes the right of all inhabitants to receive an environmental response from all public authorities, undoubtedly including municipalities, which are not exempt from the application of the constitutional rule and its implementing legislation. It is evident that, in this case, the national and local interests fully coincide; local governments therefore may and must require compliance with environmental requirements within their territory and, in the event of a conflict with the authorities governing environmental matters, may submit disputes to the appropriate judicial oversight body according to the nature of the violation.
For this reason, environmental protection rules are not constitutionally incompatible with the powers and authority of municipalities, which are required, pursuant to Article 50 of the Political Constitution, to devote themselves to environmental protection—see, in this regard, judgment number 2006-7994, at eight fifty-seven in the morning on 2 de junio de 2006—(judgment No. 2016-2830).” (Judgments reiterated in No. 2016-5319 at 9:05 on 22 de abril de 2016) In this case, the Municipalidad de La Unión failed to perform its oversight duties and to follow up on a problem documented since 2014, to the detriment of the right to a healthy and ecologically balanced environment and personal safety, because despite the time elapsed and the existence of a final ruling, it has not adopted effective measures to remedy the reported situation. Accordingly, the appeal must also be granted for violation of Articles 21 and 50 of the Constitution.”.
Accordingly, the case under review presents circumstances warranting intervention by this Chamber.
In this regard, it was established that the respondent municipality has been aware of irregular situations occurring at the locations identified by the petitioner since at least 2007, as recorded in that municipal corporation’s 2015 Internal Audit report. Nevertheless, the sworn report and the official communications from various departments of the respondent municipality that were entered into the record show that situations adversely affecting health and the environment still persist.
Thus, first, it should be noted that the aforementioned audit report stated: “(…) With respect to the property behind Dirección01, this Internal Audit determined that buildings exist which apparently lacked municipal permits, given that, according to the zoning map, the construction of residences and commercial establishments is not permitted in that area because most of it is considered an absolute spring (naciente) recharge zone. Likewise, there was no evidence of inspection work by the Fiscal and Urban Control Process, except in the case of the auto repair shop, which, despite the notices and legal proceedings initiated by this Institution, continues to operate without the corresponding business license (patente comercial). In addition to the property owners’ possible noncompliance with the Urban Regulatory Plan (Plan Regular Urbano) and the Construction Law (Ley de Construcciones), the foregoing has resulted in disorderly urban growth lacking basic municipal services such as solid-waste collection and stormwater drainage, which in turn affects the residents of developments such as La Giralda in matters of urban planning, health, and appearance.”.
Likewise, official letter no. MA-PPCI-0797-2021 stated: the land in question is a building lot, namely lot 6-T of urbanización La Giralda, described in cadastral plan A-159655-1993 and identified as property number 0280191-000, with 7,50 meters of frontage; its designated use is for construction, not for access, since it neither satisfies the minimum roadway-width requirements nor has infrastructure, and it is not shown as an access route on the official map, namely the general cadastral mosaic of Urbanización La Giralda approved by INVU and the Municipal Council. Accordingly, efforts have been made to notify the parties and regularize this activity, which is manifestly anomalous and illegal at the municipal level. This situation exceeds the authority of the Infrastructure Planning and Construction Process and must be coordinated with the Fiscal and Urban Control Process, together with the Municipal Police and other government authorities such as the Ministerio de Salud, MINAE, and IMAS.
It is recommended that an effort be undertaken to regularize and correct these anomalies, since they are causing health problems, as well as improper management of stormwater and sewage, among other issues resulting from the absence of infrastructure stemming from the illegality and failure to comply with the regulations in force (…)”. Official letter no. MA-AAP-0974-2021 also explained: “(…) we can state that when rainfall of moderate intensity (or greater) occurs, the stormwater system collapses because of the increased flow it must handle. 4. It is not known how the residences built on property recorded under real-property folio N° 2-014851-000 dispose of stormwater, since this information is unavailable due to the manner in which the buildings were constructed. Consequently, it cannot be stated that all water generated on that property is discharged through Dirección01 of urbanización La Giralda, but we can state that a considerable flow is discharged through the lot in question, overwhelming the development’s stormwater system.”.
Likewise, note the statements in official letter no. MA-ADM-1681-2021: “(…) With regard to property 2-280191—rights 001 through 008, cadastral plan A-0159655-1993, located in the district of Desamparados, La Giralda lot 6-T, by means of notice records 1371-2010 of 03 de diciembre del 2010, the registered owners were ordered to clean and fence vacant lots and construct and maintain sidewalks; they were granted 5 days to complete the required work pursuant to Article 6(a) of the Regulations to Article 75 of the Municipal Code (Reglamento al artículo 75 del Código Municipal). Within the scope of this office’s authority, upon expiration of the period granted, an inspection was conducted and it was verified that they had not completed the required work. Accordingly, a fine for failure to perform the duties set forth in subsections b) Fencing and cleaning vacant lots, and D) Construction and Maintenance of sidewalks, was assessed against the aforementioned property.
Pursuant to reinspection request 24865-2017 of 14 de noviembre de 2017, the site was visited and it was verified (sic) that they had completed the required work. It is important to clarify that, to date, the Municipal Residents’ Duties Department has not received (sic) any new complaints; nevertheless, a new inspection of the specified area was conducted on 03 de diciembre del 2021, verifying that the fence had been damaged (…) Therefore, this office will issue new notice records for property 2-280191—rights 001 through 008. This department lacks authority over unpermitted commercial activities and the use of the property as a passageway and public street.”. Official letter no. MA-PCFU-2071-2021 of 3 de diciembre de 2021 also noted: “(…) As the petitioner indeed states (sic), a lot forming part of Residencial La Giralda is used as a means of access to the aforementioned property; an electrowelded-mesh gate and an area for the installation of electric meters belonging to I.C.E were placed on that lot, together with a pedestrian entrance, and a sidewalk was built to provide access to the property.
There are currently several residences, including apartments, on the property recorded under real-property folio N° 2-14824-000. These were built without construction permits (permisos de construcción), and several closure proceedings were conducted while they were under construction. They are currently undergoing the ordinary notice procedure established in Articles 93 and 94 of the Construction Regulations (Reglamento de Construcciones). With respect to the works lacking construction permits, the following records have been issued: 179-2021, 95-2020, 128-2019, 451-2017, 388-2017, 387-2017, 94-2017, 73-2017, 130-2016, 196-2016, 139-2016, 136-2016, 137-2016, 138-2016, 129-2016, 54-2016, 55-2016, among others. During the site inspection, it was determined that the residences on the aforementioned property already have drinking-water service. With respect to commercial activities on the property, it is important to emphasize that activities such as auto repair shops, a tamale factory, small grocery stores, etc., have operated at the site for several years.
Once they are closed down, the seals are broken because they cannot obtain a license, and once the court warns them in the proceedings brought against them, the activities are discontinued by the same (sic) owners before they are tried. Two activities are currently being conducted at the site without the respective municipal license: a cabinetmaking shop, which was notified through notice form N° 013013, and a metal-article fabrication shop, which was notified through form N° 013012. Once the granted period of 8 business days provided for under this Municipality’s Business License Law (Ley de Patentes) expires, the respective establishments will be closed and each case will be monitored.”.
It is therefore apparent that the situations described above currently persist at the referenced sites (properties Dirección05 and Dirección06 in the province of Alajuela), and that the respondent municipality has not been sufficiently diligent in its oversight work or in following up on the problem identified years ago, to the detriment of a healthy environment and the health and safety of individuals, since no effective and definitive measures have been adopted to correct the reported situation. In this regard, it should be noted that forms nos. 013013 and 013012 concerning illegal commercial activities conducted at the site were not issued until notice was given that these proceedings had been instituted. Nevertheless, as evidenced by the report and the aforementioned official letters, situations still persist that must be addressed by the respondent authority in order to safeguard the fundamental rights of the persons living in the community at issue.
In view of the foregoing, the appropriate course is to grant the petition for relief (recurso), on the terms to be set forth in the operative portion of this decision.
In environmental matters, it is the undersigned’s position that, if the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the administrative litigation jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits when other rights of persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution (Constitución Política)), as is the case here, where the petitioner alleges that he is a resident of Residencial La Giralda, in Desamparados de Alajuela, where a property is used for industrial commercial activities and structures have been built without municipal permits or licenses, generating noise, water, and environmental pollution. Garbage also accumulates there. The foregoing violates the right to enjoy a healthy and ecologically balanced environment and a decent standard of living.
Although I agree with the majority of the Chamber that the petition should be granted, I partially disagree as to the forum in which the enforcement phase of this matter should be conducted, specifically regarding the corresponding procedures and actions for resolving the situation involving commercial activities and unlawful construction on the properties referenced in this petition, as well as the management of stormwater and sewage at the site. This is because the rules governing this constitutional jurisdiction lack adequate mechanisms for monitoring compliance with a judgment involving highly complex technical matters. By contrast, the provisions of the Administrative Litigation Procedure Code (Código Procesal Contencioso-Administrativo) governing enforcement (Article 155 et seq.) offer clear advantages, such as the possibility of requiring schedules, imposing fines, assigning responsibility, supervising stages of compliance, etc. Therefore, pursuant to Article 56 of the Constitutional Jurisdiction Law (Ley de Jurisdicción Constitucional), I consider that the enforcement phase should be conducted before the Enforcement Division of the Administrative and Civil Tax Court (Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda), under the Code’s judgment-enforcement rules.
The parties are advised that, if they submitted any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court within a maximum period of 30 business days from notice of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary” (Reglamento sobre Expediente Electrónico ante el Poder Judicial), approved by the Full Court at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
Therefore:
The petition is granted. Sofía Marcela González Barquero and Leslye Rubén Bojorges León, respectively, Mayor and President of the Municipal Council, both of the Municipalidad de Alajuela, or whoever holds those offices, are ordered to coordinate the pertinent matters, issue the relevant orders, and undertake all actions within the scope of their authority so that, within a maximum period of THREE MONTHS from service of this judgment, the necessary steps are taken and the corresponding proceedings are conducted in order to resolve: 1) the situation involving commercial activities and illegal construction on the properties referred to in this amparo proceeding (recurso de amparo), so as to bring them into compliance with the law; 2) the issue of stormwater and sewage management at the site, as well as other public-health problems and environmental harm resulting from the aforementioned irregular activities and construction.
The respondent authority is advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that must be complied with or enforced and fails to comply with or enforce it shall be sentenced to imprisonment for three months to two years or to a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Alajuela is ordered to pay the costs, damages, and losses caused, which shall be assessed during enforcement of the judgment (ejecución de sentencia) before the contentious-administrative jurisdiction (jurisdicción contencioso administrativa). Justice Salazar Alvarado adds a note. Justice Garro Vargas dissents with respect to the enforcement of this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, orders that it be carried out before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules established in Articles 155 et seq. of the Código Procesal Contencioso Administrativo. Let notice be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del once de febrero de dos mil veintidos .
Recurso de amparo que se tramita en expediente n.o 21-023717-0007-CO, interpuesto por MANUEL ÁNGEL MORERA PIEDRA, cédula de identidad CED01, contra la MUNICIPALIDAD DE ALAJUELA.
Resultando:
Redacta la Magistrada Alvarado Paniagua; y,
Considerando:
El recurrente manifiesta que es vecino de Alajuela, Desamparados, Dirección03. Indica que en ese sitio se ubica el Dirección01, bajo la matricula registral Alajuela-, con plano catastrado número y cuya naturaleza es terreno para construir. Asimismo, en la parte posterior de ese lote se encuentra la finca Dirección04, que colinda con el Residencial La Cataluña. Alega que actualmente el Dirección01 es utilizado como vía de paso y calle pública, por lo que se le da un uso distinto al autorizado por el Plan Regulador. Acusa que en los inmuebles aludidos se realizan actividades comerciales industriales y se han efectuado construcciones, todas ilegales, pues no cuentan con los permisos, autorizaciones y licencias municipales correspondientes. Acusa que las actividades ilegales que se desarrollan en el lugar generan contaminación sónica, acuífera y ambiental. Agrega que, dado que las actividades y construcciones son ilegales, no cuentan con el servicio de recolección de basura, por lo que esta se acumula en la zona residencial; además, señala que no hay alcantarillado pluvial ni sanitario, ni se cuenta en el sitio con aceras, caños, ni cordones, por lo que las aguas lodo, lastre y basura discurren por la vía pública del residencial La Giralda.
Recalca que las actividades y construcciones ilegales se efectúan en esta zona que es de “protección absoluta de carga hídrica y su área de flujo (acuífero)”; empero, existen pozos sépticos que contaminan los acuíferos y otras construcciones han hecho pozos ilegales que extraen agua del acuífero. Añade que en el inmueble se han instalado más de 20 servicios eléctricos del ICE para las actividades y las construcciones ilegales, los cuales están amontonados y en mal estado, lo cual genera un riesgo de incendio. Expone, también, que el inmueble no está debidamente cerrado, cercado y limpio, de acuerdo con el artículo 75 del Código Municipal. Sostiene que, debido a la situación descrita, desde el 2009 los vecinos de la urbanización han presentado denuncias ante la municipalidad; sin embargo, no se ha brindado solución alguna.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
Asimismo, no se evidenciaron labores de inspección por parte del Proceso de Control Fiscal y Urbano, con la excepción del taller mecánico, que pese a las notificaciones y procesos legales iniciados por esta Institución, continúa ejerciendo su actividad sin la patente comercial respectiva. Lo anterior tiene como consecuencia, a aparte del eventual incumplimiento al Plan Regular Urbano y a la Ley de Construcciones por parte de los propietarios del inmueble, el crecimiento urbano desordenado que no cuenta con los servicios municipales básicos tales como recolección de desechos sólidos y alcantarillado pluvial, y que a su vez, afecta a los vecinos de urbanizaciones como La Giralda, en temas de urbanismo, salud y ornato.”. (Prueba documental).
Se recomienda emprender un esfuerzo para regularizar y corregir estas anomalías ya que se están generando problemas de salud además de un mal manejo de las aguas pluviales y aguas negras, entre otros que son producto de la ausencia de infraestructura derivada de la ilegalidad y desapego a la reglamentación vigente (…)”. (Informe de la autoridad recurrida y prueba documental).
Debido a lo señalado anteriormente, podemos afirmar que al momento de presentarse lluvias con intensidades medias (o superiores), el sistema pluvial sufre colapso por el aumento en el caudal que debe manejar. 4. Se desconoce la forma en que las viviendas construidas en la finca con folio real N° 2-014851-000 realizan la disposición de las aguas pluviales, ya que no se cuenta con la información debido a la forma en que las edificaciones fueron realizadas, por lo que no se puede afirmar que todas las aguas generadas en dicha finca sean dispuestas a través del Dirección01 de la urbanización La Giralda, pero si podemos afirmar que por medio del lote en cuestión se dispone de un caudal considerable que satura el sistema pluvial de la urbanización.”. (Informe de la autoridad recurrida y prueba documental).
Con respecto a las irregularidades denunciadas, deberán ser los compañeros de Control Fiscal y Urbano quienes den seguimiento y soliciten los documentos correspondientes que avalen tanto las construcciones como las actividades comerciales ubicadas en sitio”. (Informe de la autoridad recurrida y prueba documental).
Mediante solicitud de reinspección 24865-2017 del 14 de noviembre de 2017 se visitó el sitio y se verifico (sic) que cumplieron con las obras solicitada. Es importante aclarar que a la fecha el departamento de deberes de los Munícipes no ha recibidos (sic) nuevas denuncias, sin embargo, se procedió a realizar nueva inspección en la zona señalada el 03 de diciembre del 2021, verificado que el cercado fue dañado (…) Por lo que esta dependencia procederá a realizar las nuevas actas de notificación para la finca 2-280191-derechos 001 al 008. Con relación a las actividades comerciales in permiso y al uso como vía de paso y calle pública, este departamento no tiene competencia.”. (Informe de la autoridad recurrida y prueba documental).
Entre las obras, las cuales no cuentan con permiso de construcción, se han realizado las siguientes actas: 179-2021, 95-2020, 128-2019, 451-2017, 388-2017, 387-2017, 94-2017, 73-2017, 130-2016, 196-2016, 139-2016, 136-2016, 137-2016, 138-2016, 129-2016, 54-2016, 55-2016, entre otras. En la inspección al sitio, se logró identificar que ya las viviendas en el inmueble en mención cuentan con el servicio de agua potable. En lo que respecta a las actividades comerciales en el inmueble, es importante recalcar que en el sitio durante varios años se han colocado actividades como talleres mecánicos, fábrica de tamales, pulperías, etc, los cuales una vez que son clausurados, se les realiza la violación de sellos por no poder obtener la patente y una vez que son apercibidos por el juzgado por el proceso que se les realizan, los mismo son eliminados por los mismo (sic) propietarios de las actividades, esto previo a ser juzgados.
Actualmente en el sitio, se realizan dos actividades sin su respectiva patente municipal, un taller de ebanistería el cual fue notificado mediante la boleta de notificación N° 013013 y taller de elaboración de artículos de metal, notificado mediante la boleta N° 013012, a los cuales, una vez vencido el plazo de los 8 días hábiles otorgados, que otorga la Ley de Patentes de esta Municipalidad, se les procederá con la respectiva clausura y darle seguimiento a cada caso.”. (Informe de la autoridad recurrida y prueba documental).
En el sub lite, el recurrente manifiesta que es vecino de Alajuela, Desamparados, Dirección03. Indica que en ese sitio se ubica el Dirección01, bajo la matricula registral Alajuela-, con plano catastrado número y cuya naturaleza es terreno para construir. Asimismo, en la parte posterior de ese lote se encuentra la finca Dirección04, que colinda con el Residencial La Cataluña. Alega que actualmente el Dirección01 es utilizado como vía de paso y calle pública, por lo que se le da un uso distinto al autorizado por el Plan Regulador. Acusa que en los inmuebles aludidos se realizan actividades comerciales industriales y se han efectuado construcciones, todas ilegales, pues no cuentan con los permisos, autorizaciones y licencias municipales correspondientes. Acusa que las actividades ilegales que se desarrollan en el lugar generan contaminación sónica, acuífera y ambiental. Agrega que, dado que las actividades y construcciones son ilegales, no cuentan con el servicio de recolección de basura, por lo que esta se acumula en la zona residencial; además, señala que no hay alcantarillado pluvial ni sanitario, ni se cuenta en el sitio con aceras, caños, ni cordones, por lo que las aguas lodo, lastre y basura discurren por la vía pública del residencial La Giralda.
Recalca que las actividades y construcciones ilegales se efectúan en esta zona que es de “protección absoluta de carga hídrica y su área de flujo (acuífero)”; empero, existen pozos sépticos que contaminan los acuíferos y otras construcciones han hecho pozos ilegales que extraen agua del acuífero. Añade que en el inmueble se han instalado más de 20 servicios eléctricos del ICE para las actividades y las construcciones ilegales, los cuales están amontonados y en mal estado, lo cual genera un riesgo de incendio. Expone, también, que el inmueble no está debidamente cerrado, cercado y limpio, de acuerdo con el artículo 75 del Código Municipal. Sostiene que, debido a la situación descrita, desde el 2009 los vecinos de la urbanización han presentado denuncias ante la municipalidad; sin embargo, no se ha brindado solución alguna.
Del estudio de los autos se tiene por demostrado, que la Auditoría Interna de la Municipalidad de Alajuela, mediante el informe 6-2015, concluyó: “De conformidad con los resultados obtenidos en la investigación efectuada, esta Auditoría Interna concluye, que ante la queja de los vecinos de la Urbanización La Giralda, con respecto al Dirección01, de la cual tuvo conocimiento la Administración desde el año 2007, a la fecha del presente estudio, no se le ha dado solución alguna, sino por el contrario, la situación podría haberse agravado, dadas las condiciones de la finca posterior al Dirección01, la gran cantidad de medidores de electricidad en un área de 150 m2, contiguo a las casas del residencial La Giralda y al constante tránsito por una “vía”, que no es más que un lote residencial que a la fecha se encuentra baldío. Lo anterior sin perjuicio del legajo obtenido por parte de esta Oficina de la documentación que al respecto se ha tramitado interna y externamente (oficios, actas de apercibimiento, notificaciones, directrices de la Alcaldía Municipal, entre otros), que no se materializaron en acciones concretas que pusieran un punto final a la situación del Dirección01, cuya consecuencia es la imagen de un Gobierno Local sin el empoderamiento necesario para hacer valer su jerarquía ante la organización interna municipal y hacia los munícipes, toda vez que el Código Municipal claramente dispone las obligaciones tanto de los munícipes como de los gobiernos locales, cuyas omisiones, podría generar demandas a los funcionarios municipales responsables solidariamente con los propietarios del inmueble (…) Con relación a la finca posterior al Dirección01, esta Auditoría Interna determinó la existencia de edificaciones que al parecer no contaron con los permisos municipales, dado que se acuerdo con el mapa de zonificación, no es posible la construcción de viviendas y comercio en esa zona por considerarse en su mayoría, zona de recarga absoluta de nacientes.
Asimismo, no se evidenciaron labores de inspección por parte del Proceso de Control Fiscal y Urbano, con la excepción del taller mecánico, que pese a las notificaciones y procesos legales iniciados por esta Institución, continúa ejerciendo su actividad sin la patente comercial respectiva. Lo anterior tiene como consecuencia, a aparte del eventual incumplimiento al Plan Regular Urbano y a la Ley de Construcciones por parte de los propietarios del inmueble, el crecimiento urbano desordenado que no cuenta con los servicios municipales básicos tales como recolección de desechos sólidos y alcantarillado pluvial, y que a su vez, afecta a los vecinos de urbanizaciones como La Giralda, en temas de urbanismo, salud y ornato.”. Mediante el oficio n.° MA-SGV-914-202103 de 3 de diciembre de 2021, el coordinador a.i. del Subproceso de Gestión Vial de la Municipalidad de Alajuela, indica: “El Dirección01 con el número de finca 280191 no corresponde a una vía pública de hecho, se trata de una propiedad privada inscrita a nombre de particulares.
Con respecto a las construcciones, viviendas y actividades comerciales que se realizan en la finca #14824 no corresponde a este Sub-Proceso emitir criterio”. El director del Proceso de Planeamiento y Construcción de Infraestructura de la municipalidad accionada, por medio del oficio n.° MA-PPCI-0797-2021 de 3 de diciembre de 2021, consignó: “(…) Efectivamente, el terreno señalado se trata de un terreno para construir que es el lote 6-T de urbanización La Giralda, descrito mediante plano catastrado A-159655-1993 y con número de finca 0280191-000, con frente de 7,50 metros, naturaleza para construir no para acceso, pues no cumple ni con dimensiones mínimas de ancho de vía, ni cuenta con infraestructura ni está reflejado de esa manera en el mapa oficial que es el mosaico general de catastro de Urbanización La Giralda aprobado por el INVU y el Concejo Municipal. Es por eso que se han emprendido esfuerzos para la notificación y regularización de esta actividad a todas luces anómala e ilegal a nivel municipal, situación que sobrepasa las facultades del Proceso de Planeamiento y Construcción de Infraestructura y debe ser coordinado con el Proceso Control Fiscal y Urbano en conjunto con la Policía Municipal y otras autoridades gubernamentales como el Ministerio de Salud, MINAE y el IMAS.
Se recomienda emprender un esfuerzo para regularizar y corregir estas anomalías ya que se están generando problemas de salud además de un mal manejo de las aguas pluviales y aguas negras, entre otros que son producto de la ausencia de infraestructura derivada de la ilegalidad y desapego a la reglamentación vigente (…)”. Por medio del oficio n.° MA-AAP-0974-2021 de 3 de diciembre de 2021, el Ing. Lawrence Chacón Soto, coordinador de Alcantarillado Pluvial de la Municipalidad de Alajuela, señaló: “(…) 1. Que, con respecto al manejo de las aguas pluviales del casería o lotificación que se ubica al sureste del bloque T de la urbanización La Giralda , el mismo no contó en su momento con ninguna aprobación o visto bueno por parte de la Actividad Alcantarillado Pluvial, por lo cual se desconoce la forma o las valoraciones que se llevaron a cabo en materia pluvial para la autorización del desarrollo urbano de finca madre (folio real N° 2-014824-000). 2 Que, el diseño pluvial de la urbanización La Giralda no contempla los aportes la propiedad donde se llevó a cabo el desarrollo urbanístico, esto por cuanto en los diseños de sitio no se establece ningún tipo de paso de agua o servidumbre desde la propiedad con folio real N° 2-014851 hasta el sistema pluvial de la urbanización La Giralda, por lo que es adecuado señalar que técnicamente no tendría sentido dejar prevista la tubería para el caudal que se genera en la finca mencionada. 3.
Debido a lo señalado anteriormente, podemos afirmar que al momento de presentarse lluvias con intensidades medias (o superiores), el sistema pluvial sufre colapso por el aumento en el caudal que debe manejar. 4. Se desconoce la forma en que las viviendas construidas en la finca con folio real N° 2-014851-000 realizan la disposición de las aguas pluviales, ya que no se cuenta con la información debido a la forma en que las edificaciones fueron realizadas, por lo que no se puede afirmar que todas las aguas generadas en dicha finca sean dispuestas a través del Dirección01 de la urbanización La Giralda, pero si podemos afirmar que por medio del lote en cuestión se dispone de un caudal considerable que satura el sistema pluvial de la urbanización.”. El coordinador de Actividad de Control Constructivo de la municipalidad accionada, mediante el oficio n.° MA-ACC-4828-2021 de 7 de diciembre de 2021, apuntó: “En atención al oficio No MA-PSJ-2433-20211 donde nos solicita remitir informe sobre la situación planteada por el Sr. Manuel Ángel Morera Piedra referente al hecho denunciado sobre la utilización del lote 6-T plano catastrado ubicado en Dirección03, al respecto le indico que se procedió a revisar si sobre el lote denunciado se han realizado solicitudes de uso de suelo o permisos de construcción; lo que se pudo verificar que sobre la finca en cuestión no existen solicitudes de ese tipo; por lo que el lote se encuentra en verde.
Ahora bien, verificando la información aportada referente a la finca matrícula terreno colindante con el lote 6-T, al respecto se verificó que tampoco cuenta con solicitudes de uso de suelo, disponibilidad y visado, alineamiento; sin embargo, no se lograron encontrar solicitudes de permiso de construcción que tuvieran relación con la finca de marras; véase registro de trámites del Sistema Visión2020 en formato PDF. Con respecto a las irregularidades denunciadas, deberán ser los compañeros de Control Fiscal y Urbano quienes den seguimiento y soliciten los documentos correspondientes que avalen tanto las construcciones como las actividades comerciales ubicadas en sitio”. Mediante el oficio n.° MA-ADM-1681-2021 de 6 de diciembre de 2021, la coordinadora a.i. de Actividad Deberes de los Munícipes, detalló: “(…) Referente a la finca 2-280191- derechos 001 al 008 plano catastrado A-0159655-1993 ubicada en el distrito de Desamparados, La Giralda lote 6-T, mediante actas de notificación 1371-2010 del 03 de diciembre del 2010, se procedió a solicitar a los propietarios registrales Limpiar y cercar lotes baldíos y construcción y mantenimiento de aceras, se brindó un plazo de 5 días para realizar las obras solicitadas según el artículo 6 inciso a del Reglamento al artículo 75 del Código Municipal.
Dentro de las competencias de esta dependencia cumplido el plazo otorgado, se procedió a realizar inspección y se logró verificar que no cumplieron con las obras solicitadas, por lo que, se procedió a realizar la inclusión de la multa por incumplimiento de deberes incisos b) Cercar y limpiar tanto lotes baldíos y D) Construcción y Mantenimiento de aceras a la finca en mención. Mediante solicitud de reinspección 24865-2017 del 14 de noviembre de 2017 se visitó el sitio y se verifico (sic) que cumplieron con las obras solicitada. Es importante aclarar que a la fecha el departamento de deberes de los Munícipes no ha recibidos (sic) nuevas denuncias, sin embargo, se procedió a realizar nueva inspección en la zona señalada el 03 de diciembre del 2021, verificado que el cercado fue dañado (…) Por lo que esta dependencia procederá a realizar las nuevas actas de notificación para la finca 2-280191-derechos 001 al 008.
Con relación a las actividades comerciales in permiso y al uso como vía de paso y calle pública, este departamento no tiene competencia.”. El coordinador de la Actividad de Administración del Acueducto y Saneamiento de la Municipalidad de Alajuela, por medio del oficio n.°MA-AAAS-677-2021, manifestó: “(…) ● Que de acuerdo a inspección realizada por el funcionario municipal Mario Bolaños a la propiedad N° 280191-000, según plano catastrado A-0159655-1993, se logró determinar que es un lote baldío y no posee ninguna conexión de agua potable. ● Referente a la finca N° 14828-000, me permito informarle que mediante inspección realizada igualmente por el funcionario Bolaños, se logró determinar que existen instalados 26 hidrómetros de agua potable municipal y estos se encuentran debidamente registrados en el Sistema Tributario de Cobro. Además, se logró determinar que, en este inmueble, existe la construcción de un pozo artesanal de agua potable que es administrado por un tercero y abastece 18 apartamentos, 8 viviendas y un taller de enderezado y pintura.
Cabe indicar que se procedió a realizar pruebas en la red de distribución de agua potable municipal y no se logró determinar que existiera alguna conexión irregular.”. La coordinadora de la Actividad Gestión Integral de Residuos Sólidos de la municipalidad accionada, por medio del oficio n.° MA-AGIRS-1557-2021, adujo: “(…) procedo a informarle según lo observado por nuestro inspector el señor Julio Acuña Salas en visita realizada el día de hoy lunes 06 de diciembre del año en curso al lugar indicado: 1- Realizada la inspección al Inmueble N° 014824 se verifica que este no posee actividad generadora de residuos por lo que carece del cobro por el servicio, se verifica en momento, que la zona se encuentra limpia y sin residuos acumulados dentro o en la vía pública. 2- El inmueble N° 280191 cuenta con una calle oficialmente parte de la red vial cantonal, así acordado por el Concejo Municipal (ver oficio MA-SCM-246-2020).
En esta se presta el servicio de manejo de residuos sólidos ordinarios en la modalidad puerta a puerta tal y como lo requiere la legislación vigente. 3- Como parte de las labores ordinarias de esta dependencia se procederá a la revisión y actualización de los cargos correspondientes a los propietarios de los inmuebles allí ubicados según la cantidad y tipo de actividad generadora que realicen, tal y como lo dispone el Reglamento municipal.”. Mediante el oficio n.° MA-PCFU-2071-2021 de 3 de diciembre de 2021, el encargado del Proceso de Control Fiscal y Urbano de la Municipalidad de Alajuela, sostuvo: “Como se desprende del amparo, sobre el inmueble finca folio real N° 2-14824-000, el cual actualmente consta de 64 derechos, entre ellos sociedades anónimas, se han realizado ya varias diligencias. Que efectivamente como lo indica en (sic) recurrente, un lote que forma parte del Residencial La Giralda es utilizado como medio de acceso al inmueble mencionado anteriormente, que sobre ese lote se colocó un portón en malla electrosoldada y un área para la colocación de medidores eléctricos de la empresa I.C.E, y entre ellas un acceso peatonal y se realizó una acera como acceso al inmueble.
Que actualmente sobre el inmueble folio real N° 2-14824-000, existen varias viviendas entre ellas departamentos, los cuales se han realizado sin permisos de construcción, sobre las cuales ya se han efectuado varios procesos de clausura durante su realización, los cuales se están en proceso de realizarles el procedimiento normal de notificación, establecidos en los artículos 93 y 94 del Reglamento de Construcciones. Entre las obras, las cuales no cuentan con permiso de construcción, se han realizado las siguientes actas: 179-2021, 95-2020, 128-2019, 451-2017, 388-2017, 387-2017, 94-2017, 73-2017, 130-2016, 196-2016, 139-2016, 136-2016, 137-2016, 138-2016, 129-2016, 54-2016, 55-2016, entre otras. En la inspección al sitio, se logró identificar que ya las viviendas en el inmueble en mención cuentan con el servicio de agua potable. En lo que respecta a las actividades comerciales en el inmueble, es importante recalcar que en el sitio durante varios años se han colocado actividades como talleres mecánicos, fábrica de tamales, pulperías, etc, los cuales una vez que son clausurados, se les realiza la violación de sellos por no poder obtener la patente y una vez que son apercibidos por el juzgado por el proceso que se les realizan, los mismo son eliminados por los mismo (sic) propietarios de las actividades, esto previo a ser juzgados.
Actualmente en el sitio, se realizan dos actividades sin su respectiva patente municipal, un taller de ebanistería el cual fue notificado mediante la boleta de notificación N° 013013 y taller de elaboración de artículos de metal, notificado mediante la boleta N° 013012, a los cuales, una vez vencido el plazo de los 8 días hábiles otorgados, que otorga la Ley de Patentes de esta Municipalidad, se les procederá con la respectiva clausura y darle seguimiento a cada caso.”. El alcalde y el jefe del Departamento de Gestión Vial, ambos de la Municipalidad de Alajuela, fueron notificados de la resolución de curso de este proceso el 2 de diciembre de 2021. El 3 de diciembre de 2021, la municipalidad recurrida emitió la boleta n.° 013012, en la que se consignó: “Elaboración artículos metal (…) Nombre01 (…) EN INSPECCION REALIZADA AL ESTABLECIMIENTO, SE CONSTATO LO SIGUIENTE a. No cuenta con licencia municipal (Art. 1 Ley 8236) X (…) Se le apercibe que en un plazo de 08 días hábiles debe poner a derecho la situación del establecimiento comercial, caso contrario se procederá a la clausura del local y/o al decomiso del licor, conforme a lo dispuesto en los artículos 1 y siguientes de la Ley 8236 del Impuestos Municipales del Cantón Central de Alajuela y los artículos 79, 81 bis y 83 del Código Municipal y la Ley de Licores (…) Finca 14824.”.
El 3 de diciembre de 2021, la municipalidad recurrida emitió la boleta n.° 013013, en la que se indicó: “Taller ebanistería (…) Nombre02 (…) actividad comercial (…) EN INSPECCION REALIZADA AL ESTABLECIMIENTO, SE CONSTATO LO SIGUIENTE a. No cuenta con licencia municipal (Art. 1 Ley 8236) X (…) Se le apercibe que en un plazo de 08 días hábiles debe poner a derecho la situación del establecimiento comercial, caso contrario se procederá a la clausura del local y/o al decomiso del licor, conforme a lo dispuesto en los artículos 1 y siguientes de la Ley 8236 del Impuestos Municipales del Cantón Central de Alajuela y los artículos 79, 81 bis y 83 del Código Municipal y la Ley de Licores (…) Finca 14824.”. El presidente del Concejo Municipal de Alajuela fue notificado de la resolución de curso de este proceso el 7 de diciembre de 2021.
Sobre el particular, interesa traer a colación lo dispuesto por este Tribunal en la sentencia n.° 2019021889 de las 9:45 horas de 8 de noviembre de 2019:
II.Objeto del recurso. Los recurrentes estiman lesionados sus derechos fundamentales, ya que en los cerros de la Carpintera, los cuales se encuentran protegidos por medio del decreto ejecutivo n.º 6112-A-MAG, se han realizado construcciones sin permisos municipales, que incumplen los requisitos mínimos de ingeniería y dañan el ambiente, pues están ubicadas en una zona de amortiguamiento, lo que, además, genera riesgos de deslizamiento y es un peligro para vidas humanas. Señalan que el 13 de junio de 2019 remitieron gestiones al Alcalde de la Unión respecto al caso; sin embargo, el recurrido no ha tomado acciones concretas para atender y dar respuesta a sus denuncias (…)
Se recuerda al recurrido, que este Tribunal ha indicado que el derecho a un ambiente sano y equilibrado obliga al Estado a procurar una protección adecuada al ambiente, esto es, a tomar las medidas necesarias para evitar que las alteraciones producidas por la actividad humana constituyan una lesión al ambiente. De esa forma, en caso de que exista un riesgo de daño grave o irreversible al ambiente -o una duda fundada al respecto-, los principios rectores del Derecho al Ambiente exigen medidas de prevención o precaución para que esa afectación no se produzca o se posponga la actividad de que se trate, por cuanto de producirse las consecuencias biológicas y sociales nocivas, una resolución a posteriori resultaría ineficaz y se limitaría a una trascendencia moral. En este orden de ideas, la doctrina especializada ha señalado que el principio preventivo requiere que cuando haya certeza de posibles daños al ambiente, la actividad afectante debe ser prohibida, limitada, o condicionada al cumplimiento de ciertos requerimientos.
En general, este principio aplica cuando existen riesgos claramente definidos e identificados al menos como probables. Este principio se puede aplicar cuando no existen informes técnicos o permisos administrativos que garanticen la sostenibilidad de una actividad, pero existen elementos suficientes para preveer eventuales impactos negativos. Por otra parte, el principio precautorio se refiere a los casos en los que, según el principio 15 de la Declaración de Río, existe falta de certeza científica sobre los riesgos y sus impactos de cierta actividad. En general, se indica que la diferencia entre el principio preventivo y precautorio radica en el nivel de conocimiento y certeza de los riesgos que una actividad u obra genere. El principio precautorio solo aplica si existe tal estado de duda resultado de determinada información científica, estudios técnicos, etc., que estén disponibles o se hayan realizado.
Así, el Estado costarricense se encuentra obligado a velar y a adoptar las medidas que garanticen la defensa y preservación efectiva del medio ambiente. El Derecho a la Constitución exige utilizar todos los medios disponibles -sean estos jurídicos o fácticos- para preservar el ambiente. En materia ambiental, tanto la Administración como la ciudadanía en general tienen la obligación de velar por su protección, de forma que un funcionario no se puede limitar simplemente a declararse incompetente y menos aún, omitir cumplir con sus deberes de fiscalización y restablecimiento del ordenamiento jurídico. El artículo 50 constitucional obliga al Estado y demás instituciones públicas a intervenir activamente en la protección del ambiente (ver sentencia número 2011-010889 de las 15:22 horas del 16 de agosto del 2011). En aplicación de tales principios y cuando así resulte procedente, la administración debe abstenerse de autorizar, aprobar o permitir toda solicitud nueva o de modificación, suspender las que estén en curso hasta que se despeje el estado dubitativo y, paralelamente, adoptar todas las medidas tendientes a su protección y preservación con el objeto de garantizar el derecho a un ambiente sano y ecológicamente equilibrado.
En el sub examine, la omisión del recurrido apuntada por los recurrentes y constatada por este Tribunal es inaceptable, tomando en consideración que el municipio es el primer llamado a atender los problemas de su localidad, ya que la problemática descrita se ha debido a la falta de previsiones y controles necesarios de previo a las construcciones autorizadas. Tales deberes han sido precisados por este Tribunal en su jurisprudencia:
“Sobre la tutela de los intereses locales enmarcada en el artículo 169 de la Constitución Política. En otras ocasiones, esta Sala ha señalado que dicho artículo establece que la administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal. Los intereses y servicios locales han sido definidos por la Sala como conceptos jurídicos indeterminados, donde la ley no resuelve con exactitud su contenido para su aplicación a casos concretos, por lo que resulta necesario acudir a criterios de valor y de experiencia, por parte de quien le corresponde aplicarlo, para determinar su contenido (ver en ese sentido la resolución Nº 2007-002402). Estos intereses y servicios locales, si bien a quien corresponde tutelarlos de manera genérica es al Gobierno Municipal, este puede distribuir sus tareas en diferentes funcionarios con el fin de buscar la manera más efectiva de protección de dichos intereses; es decir, el Gobierno Municipal, incluidos el Alcalde y los regidores municipales, tienen a su disposición todo un cuerpo de funcionarios que tienen la potestad de tomar una serie de decisiones con el fin de dividir funciones y tareas, reducir trabajo, y principalmente por criterios de especialidad, ya que existen funcionarios técnica y académicamente más capacitados que otros para la toma de ciertas decisiones” (ver sentencias número 2008-001604 y 2015-11089) “VII.- El papel de las municipalidades en materia ambiental.
De conformidad con lo dicho, las municipalidades, como parte integrante del todo que es el Estado, tienen dentro del ámbito de sus competencias y obligaciones una alta dosis de responsabilidad en materia ambiental, sea mediante la aprobación directa de permisos o licencias para las cuales se exija el previo cumplimiento de requisitos que acrediten ante otras instancias del poder público el adecuado manejo ambiental, como mediante inspecciones regulares y canalización de situaciones de riesgo ante las instancias con mayor competencia de intervención. Ha quedado establecido ya que a los gobiernos locales les alcanza la obligación de coordinación y prevención en materia ambiental dentro del ámbito de su jurisdicción territorial, de donde resulta que ciertamente las municipalidades son actores importantes en la tarea de protección al ambiente. Es indubitable la facultad de los gobiernos locales para darse su propia ordenación territorial a través de los planes reguladores; pero la existencia de éstos -que en su mayoría carecen de complementos de ordenación desde el punto de vista del ambiente sano y ecológicamente equilibrado- no produce la desaplicación de la legislación tutelar ambiental.
Por el contrario, estima la Sala que debe ser requisito fundamental, que no atenta contra el principio constitucional de la autonomía municipal, el que todo plan regulador deba considerar, de previo a ser aprobado y desarrollado, con un examen del impacto ambiental desde la perspectiva que da el artículo 50 constitucional, para que el ordenamiento del suelo y sus diversos regímenes sean compatibles con los alcances de la norma superior, sobre todo, valorando que esta disposición establece el derecho de todos los habitantes a obtener una respuesta ambiental de todas las autoridades públicas y ello incluye, sin duda, a las municipalidades, quienes no están exentas de la aplicación de la norma constitucional y de su legislación de desarrollo. Es evidente que en este caso, es totalmente coincidente el interés nacional y el local, y por ello los gobiernos locales pueden y deben exigir el cumplimiento de requisitos ambientales en su territorio, y en caso de conflicto con las autoridades rectoras de la materia ambiental, pueden someter las controversias al contralor jurisdiccional que corresponda según la naturaleza de la infracción.
Es por lo anterior que las normas tutelares del ambiente no son incompatibles, desde el punto de vista constitucional, con las facultades y competencias de las municipalidades, las que están obligadas, por imperativo del artículo 50 de la Constitución Política, a prodigarse en la protección del ambiente –ver, en este sentido, sentencia número 2006-7994, de las ocho horas cincuenta y siete minutos del 2 de junio de 2006- (sentencia No. 2016-2830).” (Sentencias reiteradas en la No. 2016-5319 de las 9:05 horas del 22 de abril de 2016) En este caso, la Municipalidad de La Unión incumplió su labor de fiscalización, y de dar seguimiento a un problema evidenciado desde el año 2014, en detrimento del derecho a un ambiente sano y ecológicamente equilibrado y de la seguridad de las personas, pues a pesar del tiempo transcurrido y de lo ya resuelto en firme, no ha adoptado medidas efectivas para corregir la situación denunciada. Por consiguiente, también procede acoger el recurso por violación a los artículos 21 y 50 constitucionales.”.
Así las cosas, en el sub examine se verifican situaciones que ameritan la injerencia de esta Sala.
Al respecto, se tuvo por demostrado que la municipalidad accionada ha tenido conocimiento de situaciones irregulares que se producen en los sitios señalados por la parte accionante, al menos desde el año 2007, según lo consignado en el informe de la Auditoría Interna de esa corporación del año 2015. Sin embargo, del informe rendido bajo juramento y de los oficios de distintas dependencias de la municipalidad recurrida que fueron aportados a los autos, se desprende que aún persisten situaciones que están ocasionando una afectación a la salud y al ambiente.
Así pues, véase en primer lugar que, en el mismo informe de auditoría aludido, se indicó: “(…) Con relación a la finca posterior al Dirección01, esta Auditoría Interna determinó la existencia de edificaciones que al parecer no contaron con los permisos municipales, dado que se acuerdo con el mapa de zonificación, no es posible la construcción de viviendas y comercio en esa zona por considerarse en su mayoría, zona de recarga absoluta de nacientes. Asimismo, no se evidenciaron labores de inspección por parte del Proceso de Control Fiscal y Urbano, con la excepción del taller mecánico, que pese a las notificaciones y procesos legales iniciados por esta Institución, continúa ejerciendo su actividad sin la patente comercial respectiva. Lo anterior tiene como consecuencia, a aparte del eventual incumplimiento al Plan Regular Urbano y a la Ley de Construcciones por parte de los propietarios del inmueble, el crecimiento urbano desordenado que no cuenta con los servicios municipales básicos tales como recolección de desechos sólidos y alcantarillado pluvial, y que a su vez, afecta a los vecinos de urbanizaciones como La Giralda, en temas de urbanismo, salud y ornato.”.
Asimismo, en el oficio n.° MA-PPCI-0797-2021, se indicó: el terreno señalado se trata de un terreno para construir que es el lote 6-T de urbanización La Giralda, descrito mediante plano catastrado A-159655-1993 y con número de finca 0280191-000, con frente de 7,50 metros, naturaleza para construir no para acceso, pues no cumple ni con dimensiones mínimas de ancho de vía, ni cuenta con infraestructura ni está reflejado de esa manera en el mapa oficial que es el mosaico general de catastro de Urbanización La Giralda aprobado por el INVU y el Concejo Municipal. Es por eso que se han emprendido esfuerzos para la notificación y regularización de esta actividad a todas luces anómala e ilegal a nivel municipal, situación que sobrepasa las facultades del Proceso de Planeamiento y Construcción de Infraestructura y debe ser coordinado con el Proceso Control Fiscal y Urbano en conjunto con la Policía Municipal y otras autoridades gubernamentales como el Ministerio de Salud, MINAE y el IMAS.
Se recomienda emprender un esfuerzo para regularizar y corregir estas anomalías ya que se están generando problemas de salud además de un mal manejo de las aguas pluviales y aguas negras, entre otros que son producto de la ausencia de infraestructura derivada de la ilegalidad y desapego a la reglamentación vigente (…)”. También, en el oficio n.° MA-AAP-0974-2021, se detalló: “(…) podemos afirmar que al momento de presentarse lluvias con intensidades medias (o superiores), el sistema pluvial sufre colapso por el aumento en el caudal que debe manejar. 4. Se desconoce la forma en que las viviendas construidas en la finca con folio real N° 2-014851-000 realizan la disposición de las aguas pluviales, ya que no se cuenta con la información debido a la forma en que las edificaciones fueron realizadas, por lo que no se puede afirmar que todas las aguas generadas en dicha finca sean dispuestas a través del Dirección01 de la urbanización La Giralda, pero si podemos afirmar que por medio del lote en cuestión se dispone de un caudal considerable que satura el sistema pluvial de la urbanización.”.
Asimismo, véase lo señalado en el oficio n.° MA-ADM-1681-2021: “(…) Referente a la finca 2-280191- derechos 001 al 008 plano catastrado A-0159655-1993 ubicada en el distrito de Desamparados, La Giralda lote 6-T, mediante actas de notificación 1371-2010 del 03 de diciembre del 2010, se procedió a solicitar a los propietarios registrales Limpiar y cercar lotes baldíos y construcción y mantenimiento de aceras, se brindó un plazo de 5 días para realizar las obras solicitadas según el artículo 6 inciso a del Reglamento al artículo 75 del Código Municipal. Dentro de las competencias de esta dependencia cumplido el plazo otorgado, se procedió a realizar inspección y se logró verificar que no cumplieron con las obras solicitadas, por lo que, se procedió a realizar la inclusión de la multa por incumplimiento de deberes incisos b) Cercar y limpiar tanto lotes baldíos y D) Construcción y Mantenimiento de aceras a la finca en mención.
Mediante solicitud de reinspección 24865-2017 del 14 de noviembre de 2017 se visitó el sitio y se verifico (sic) que cumplieron con las obras solicitada. Es importante aclarar que a la fecha el departamento de deberes de los Munícipes no ha recibidos (sic) nuevas denuncias, sin embargo, se procedió a realizar nueva inspección en la zona señalada el 03 de diciembre del 2021, verificado que el cercado fue dañado (…) Por lo que esta dependencia procederá a realizar las nuevas actas de notificación para la finca 2-280191-derechos 001 al 008. Con relación a las actividades comerciales in permiso y al uso como vía de paso y calle pública, este departamento no tiene competencia.”. También, en el oficio n.° MA-PCFU-2071-2021 de 3 de diciembre de 2021, se anotó: “(…) Que efectivamente como lo indica en (sic) recurrente, un lote que forma parte del Residencial La Giralda es utilizado como medio de acceso al inmueble mencionado anteriormente, que sobre ese lote se colocó un portón en malla electrosoldada y un área para la colocación de medidores eléctricos de la empresa I.C.E, y entre ellas un acceso peatonal y se realizó una acera como acceso al inmueble.
Que actualmente sobre el inmueble folio real N° 2-14824-000, existen varias viviendas entre ellas departamentos, los cuales se han realizado sin permisos de construcción, sobre las cuales ya se han efectuado varios procesos de clausura durante su realización, los cuales se están en proceso de realizarles el procedimiento normal de notificación, establecidos en los artículos 93 y 94 del Reglamento de Construcciones. Entre las obras, las cuales no cuentan con permiso de construcción, se han realizado las siguientes actas: 179-2021, 95-2020, 128-2019, 451-2017, 388-2017, 387-2017, 94-2017, 73-2017, 130-2016, 196-2016, 139-2016, 136-2016, 137-2016, 138-2016, 129-2016, 54-2016, 55-2016, entre otras. En la inspección al sitio, se logró identificar que ya las viviendas en el inmueble en mención cuentan con el servicio de agua potable. En lo que respecta a las actividades comerciales en el inmueble, es importante recalcar que en el sitio durante varios años se han colocado actividades como talleres mecánicos, fábrica de tamales, pulperías, etc, los cuales una vez que son clausurados, se les realiza la violación de sellos por no poder obtener la patente y una vez que son apercibidos por el juzgado por el proceso que se les realizan, los mismo son eliminados por los mismo (sic) propietarios de las actividades, esto previo a ser juzgados.
Actualmente en el sitio, se realizan dos actividades sin su respectiva patente municipal, un taller de ebanistería el cual fue notificado mediante la boleta de notificación N° 013013 y taller de elaboración de artículos de metal, notificado mediante la boleta N° 013012, a los cuales, una vez vencido el plazo de los 8 días hábiles otorgados, que otorga la Ley de Patentes de esta Municipalidad, se les procederá con la respectiva clausura y darle seguimiento a cada caso.”.
De este modo, se aprecia que actualmente persisten situaciones en los sitios aludidos (inmuebles Dirección05 y Dirección06 de la provincia de Alajuela) y que la municipalidad recurrida no ha sido lo suficientemente diligente en su labor de fiscalización y de dar seguimiento al problema evidenciado desde años atrás, en detrimento de un ambiente sano y de la salud y seguridad de las personas, pues no se han adoptado medidas efectivas y definitivas para corregir la situación denunciada. En tal sentido, véase que no fue sino hasta la notificación del curso de este proceso que se emitieron las boletas n.os 013013 y 013012, respecto a actividades comerciales ilegales que se dan en el sitio; no obstante, como se evidencia en el informe y en los oficios antes aludidos, persisten aún situaciones que deben ser atendidas por la autoridad accionada a los efectos del resguardo de los derechos fundamentales de las personas que habitan en la comunidad de marras.
En virtud de lo expuesto, lo procedente es declarar con lugar el recurso, en los términos que se indicarán en la parte dispositiva de este pronunciamiento.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que es vecino del Residencial La Giralda, en Desamparados de Alajuela, donde existe un inmueble que realiza actividades comerciales industriales y se han efectuado construcciones sin permisos o licencias municipales, los cuales generan contaminación sónica, acuífera y ambiental. Además, se acumula la basura. Lo anterior, en violación al derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero parcialmente sobre dónde residenciar la fase de ejecución del asunto, específicamente en cuanto a los procedimientos y acciones correspondientes para solucionar la situación de actividades comerciales y construcciones irregulares en los inmuebles aludidos en este recurso, así como la situación del manejo de las aguas pluviales y negras en el sitio, lo anterior debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Sofía Marcela González Barquero y a Leslye Rubén Bojorges León, por su orden, alcaldesa y presidente del Concejo Municipal, ambos de la Municipalidad de Alajuela, o a quienes ocupen esos cargos, que coordinen lo correspondiente, giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias, para que, en el plazo máximo de TRES MESES, contado a partir de la notificación de esta sentencia, se realicen las diligencias necesarias y se lleven a cabo los procedimientos correspondientes a los efectos de solucionar: 1) la situación de actividades comerciales y construcciones ilegales en los inmuebles aludidos en este recurso, con el objeto de que sean ajustadas a derecho; 2) la cuestión del manejo de las aguas pluviales y negras en el sitio, así como otros problemas de salud pública y afectación al ambiente producto de las actividades y construcciones irregulares supracitadas.
Se advierte a la autoridad recurrida que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Alajuela al pago de las costas, daños y perjuicios causados, los que se liquidarán en ejecución de sentencia ante la jurisdicción contencioso administrativa. El magistrado Salazar Alvarado pone nota. La magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Notifíquese.
