ACTION OF UNCONSTITUTIONALITY PETITIONER:
ASOCIACION CONFRATERNIDAD GUANACASTECA CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at fifteen hours and thirty-nine minutes on the ninth of February of two thousand and twenty-two.
The action of unconstitutionality (acción de inconstitucionalidad) filed by [Nombre01 001], residence ID number [CED01], acting on behalf of the ASOCIACIÓN COFRATERNIDAD GUANACASTECA, corporate registration number CED02, against Articles 7 and 9 of Decreto Ejecutivo n.° 32868, Canon por Concepto de Aprovechamiento de Aguas, published in La Gaceta n.° 21 of January 30, 2006, is hereby admitted for review, on the grounds that those provisions are contrary to Articles 21, 33, and 50 of the Constitución Política. A period of fifteen days is granted for the Attorney General of the Republic, the Minister of the Presidency of the Republic, and the Minister of Environment and Energy to submit their observations. The challenged provisions are contested on the grounds that they create a category of water users with unjustified privileges contrary to legitimate rights. This causes direct and indirect harm to others and has negative impacts on the priority of protecting human health and national ecosystems.
The petitioner clarifies that the only relief sought is a declaration of unconstitutionality and the issuance of an interpretive ruling to equalize the different categories of agricultural use, as defined and included in Article 5 of the same decree, which would then regulate those currently unjustly benefited by the challenged Articles 7 and 9. The challenged articles provide as follows: "Article 7°- In the case of water use for irrigation of rice, sugarcane, pasture, coffee, and African palm crops, as they are traditional extensive crops exposed to special market conditions, the applicable amount shall be 0.12 colones per cubic meter per year of surface water under concession (concesión) and 0.16 colones per cubic meter of groundwater under concession." "Article 9°- Given the particular nature of the Arenal Tempisque Irrigation District (DRAT), within which a public irrigation service is provided by the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) under a water supply scheme subject to hydroelectric priority, SENARA shall pay a total water-use fee (canon) of 0.12 colones per cubic meter per year, to be collected gradually as stipulated in the following Article 10." (Underlining is the petitioner's.) The petitioner considers that these two articles contravene the recitals of the same decree and also several principles and laws currently in force, and that they violate the Constitución Política.
All agricultural uses can and must be equalized with those classified under Article 5 of the same decree. The petitioner notes that the relationship between water, health, and the right to life, enshrined in constitutional Article 21, is clear and indisputable. The priority must be human consumption. Privileging economic use in agriculture to such a degree affects, in some areas, the quality, quantity, and availability of water for the supply of human consumption. This is primarily because peak demands in agricultural irrigation occur during the dry season, precisely when water in the aquifers (acuíferos) is most needed.
The petitioner states that this action of unconstitutionality is grounded in the violation of the equality principle of Article 33, and contests a clear discrimination in the management of a public asset that is entirely under State control and is being managed in a wholly unequal manner without any valid justification, thereby harming the basic, indispensable, daily, and routine activities of the population, as well as the equitable development of other economic activities. The petitioner emphasizes the violations of Article 50 of the Constitución Política, particularly with respect to its final paragraph, which provides: "Every person has the fundamental, basic, and inalienable human right of access to drinking water as an essential good for life. Water is a national asset, indispensable to protect that human right. Its use, protection, sustainability, conservation, and exploitation shall be governed by the law to be enacted for these purposes, and the supply of drinking water for the consumption of persons and communities shall take priority." In the petitioner's view, the economic dimension — whether called cost, canon, fee, investment, or revenue — is decisive in the provision, omission, or quality of a public service.
Without water there is no life. For this reason, giving away vast quantities of the water resource at almost no charge affects the costs and quality of service received by residents in need of drinking water. The question is: is it just and constitutional for the 10 percent of water allocated to human consumption to bear the costs of the 70 percent allocated to irrigation?
The petitioner argues that it is clear and indisputable that, by discriminating according to crop type — as Article 7 (challenged here) does with rice, sugarcane, coffee, and African palm — an injustice is committed against small and medium-sized farmers growing all other crops, without solid technical justification. In the case of the also-challenged Article 9, the principles set forth in the first paragraph of Article 50 of the Constitución Política are likewise grossly violated, creating a geographic discrimination in favor of those located within the Arenal Tempisque Irrigation District — SENARA zone. In general, this benefits 4 large sugarcane and rice farms. The production of thousands of farmers dedicated to growing basic food staples (canasta básica) — such as vegetables, fruits, tomatoes, onions, potatoes, beans, corn, and other crops of enormous importance for the health, life, and economy of Costa Rica — is neither organized nor encouraged.
Entirely contrary to the stated objective of "stimulating production and the most adequate distribution of wealth," what is occurring is a shameless promotion of monocultures and an ever greater concentration of wealth in very few hands. As evidence of this claim, the petitioner states that he submits pages from the report on irrigation concessions using water from the Río Tempisque in Guanacaste, which include several that grant the enjoyment of the water resource at more than 1,000 liters per second each, with one outstanding concession granted by MINAE to Central Azucarera Tempisque — CATSA for a flow rate (caudal) of 5,750 liters per second. And the same company holds other concessions as well. As a point of comparison, the petitioner notes that the total drinking water consumed by the entire Province of Guanacaste — through aqueducts operated by the Instituto Costarricense de Acueductos y Alcantarillados combined with the hundreds of community ASADAS — is less than the 5,750 liters per second flow rate granted by MINAE in this single concession.
That is the reality of MINAE's mismanagement, granting concessions for enormous water volumes at prices subsidized by the community. Everyone, without the need for a university education or laboratory analysis, knows that the molecular composition of water is H₂O. The popular saying simplifies this fact by stating that two drops of water are "exactly alike." The difference between two drops of water is caused by external agents. Water can dissolve and carry various organic or chemical substances. There is salt water, dirty water, water with fecal coliforms, contaminated water, drinking water, chlorinated water, water solidified into ice or snow, water gasified into steam and clouds, etc. In all cases, water remains water.
The petitioner argues that the vast difference in the cost of water among different users puts the most vulnerable and sensitive consumers at risk. Since water for human consumption has been declared a priority and a human right, and since its absence endangers the health and lives of inhabitants, the petitioner invokes Article 21 of the Constitución Política. Eliminating that enormous disparity will help in the conservation and efficient use of this vital resource, making it sustainable. This, in turn, makes it easier for the institutions responsible for the public drinking water service to fulfill that mandate adequately. Equality before the law is a basic principle, enshrined in the Constitución Política in Article 33, which states that "every person is equal before the law and no discrimination contrary to human dignity may be practiced." In this case, the poorest residents, who consume less than 16 m³ per month in their homes and receive the supposedly subsidized water service through the Instituto Costarricense de Acueductos y Alcantarillados, pay a minimum of 409 colones per cubic meter. Against this reality, Azucarera el Viejo, owned by Mr. Álvaro Jenkins, CATSA, owned by Guatemalan businesspeople, and Ingenio Taboga, owned by the [Nombre02] and [Nombre03] families — who receive thousands of cubic meters every second of the day — pay only 14 centavos de colón per m³.
Article 3 of that same decree states: "The canon for water use encompasses the value of use and the environmental service of protection of the water resource." The studies conducted in 2004 that provided the technical basis for the definition of the canon support, for agricultural use, the values defined in Article 5. They never contemplated or justified the exceptions set out in Articles 7 and 9 challenged here. These enormous privileges were granted through political arrangements to benefit groups with significant economic and political power in Costa Rica — known as coffee growers, sugarcane growers, rice growers, and one oil and margarine producer. The only argument offered to justify these privileges appears in Article 7, which states "as they are traditional extensive crops exposed to special market conditions." To claim that African palm should be considered a traditional crop is not at all accurate.
Corn and beans rank above it in that category of traditional products and are not excluded. The categorization of these as extensive crops is correct. And to that it must be added that most of this production is concentrated in a few hands, in large landholdings (latifundios) or groups of related corporations. And that may well have been the reason for granting the great benefit of inclusion in the privileged sector of the challenged Article 7. As for the other argument advanced — "exposed to special market conditions" — the petitioner states that he is not aware of any study, law, or verified data supporting this assertion. The argument "exposed to special market conditions" must be considered as having no connection to the setting of a water irrigation fee. Other tools and bodies exist for that purpose, tasked with overseeing the competitiveness and rules of the agricultural market. As an example, the petitioner points to a recent executive decree obtained by LAICA that imposes a 73 percent tax on sugar imported into Costa Rica.
The petitioner considers that the privilege challenged here is not a trivial matter. In the original 2006 decree, for agricultural use, Article 5 sets a canon of 1.29 and 1.40 colones per m³. In the challenged Articles 7 and 9, the fee applicable to agricultural use determined by crop type or geographic location is reduced to 12 and 16 centavos per m³. This represents a 90 percent difference. In other words, some pay only 10 percent of the canon that the rest of the farmers must pay. That difference is maintained with the updates applied to the canon (oficio DA-0071-2021).
The DRAT is administered by SENARA. The challenged Article 9, which the petitioner requests be declared unconstitutional and repealed, refers to this district. SENARA must be considered an intermediary concessionaire (concesionario) between MINAE, which grants the right, and the end user of the irrigation water. The petitioner states that it is important to highlight several matters for consideration in understanding the situation: the DRAT had essentially two main canals. The southern canal, which reached Bebedero de Cañas, and the western canal, which covers the left bank of the Tempisque. The works for the western canal were built by COOPEVICA under a concession-partnership contract (contrato de concierto) authorized and regulated by Decreto Ejecutivo n.° 28333-MAG.
COOPEVICA was incorporated by public deed (escritura pública) in 2000 before notary Gastón Francisco Peralta Volio, by Gonzalea Alvarado of El Pelón de la Bajura, Álvaro Jenkins Morales of Inversiones Tonosi, Larry Stewwart Postel of Ganadera El Cortez S.Nombre04, and two additional persons. In exchange for those works, they reserved the right to use the waters at no cost or payment whatsoever for 10 years. The petitioner (accionante) argues that today the major beneficiaries of the DRAT include grupo Taboga, Hacienda El Pelón, CATSA, and Azucarera el Viejo, each with approximately 3,000 liters per second. That is, in this case we again find some of the same beneficiaries as in the other challenged article.
The petitioner alleges that the egregious disparity among equals contravenes a basic principle of equality before the law, enshrined in Article 33 of the Constitución Política. The equality violated in this case is twofold. Water is water — it is the same resource. The other equality that is breached is between persons or companies engaged in the same rural activity: agriculture. Differentiating between growers of corn and beans, or plantains, or carrots and potatoes, as against growers of rice, sugarcane, or oil palm, has no legal basis or justification.
Furthermore, the petitioner also considers that Articles 7 and 9 flagrantly violate what is stated in Article 50 of the Constitución Política, which provides: "The State shall seek the greatest well-being for all inhabitants of the country, organizing and stimulating production and the best distribution of wealth." Articles 7 and 9, by granting an undeserved and unjustified privilege to those who operate large monoculture (monocultivos) enterprises and large landholdings (latifundios), entirely contradicts that provision. Favoring already powerful sectors of coffee, sugarcane, rice, and oil-palm growers promotes the concentration of wealth. Moreover, it unnecessarily harms other productive sectors that require water for the irrigation (riego) of their crops.
The petitioners state that what they seek is for the water use fee (canon de aprovechamiento de aguas) to recover or collect, on behalf of the State, at least the environmental cost (costo ambiental) of water. Otherwise, an unsustainable subsidy or management approach is being accepted and legalized, to the detriment of current and future generations.
The environmental cost of water, or water resource protection fee (tarifa de protección del recurso hídrico), is the central point underpinning this petition. The environmental cost of water is investment in the purchase and conservation of recharge areas (áreas de recarga) — national parks, private reserves, protected zones, and river and stream channels, lakes, estuaries, and the like — maintaining forests is essential, as is guaranteeing the full natural cycle of the water resource. This has a cost, and the petitioner states that the reference authority in this matter is the Autoridad Reguladora de Servicios Públicos (ARESEP), which is the public technical institution that defines costs and rates (tarifas), and controls the proper management of the resource, pursuant to Ley n.° 7593 and its regulations. In the case of water, ARESEP has a water oversight office (intendencia de aguas) and has issued several resolutions defining the expenditure required to protect the water, for its use and that of future generations. The petitioner states that this is offered as an appropriate, valid, legally in-force, technical, logical, recognized, and suitable reference point for comparison with what is being requested, so as to appropriately justify the reasonableness of a ruling in favor of the claim.
In this regard, the petitioner submits as annexes resolution RE-0213-JD-2018 of December 4, 2018, the rate methodology for water resource protection, which defines the environmental cost of water and provides mathematical formulas for its calculation. Based on that methodology, ARESEP defined the water resource protection fee and applied it in resolution RE-0005-IA-2019 from expediente ET-087-2019, published in La Gaceta n.° 242 of December 19, 2019. In that resolution, the water resource protection fee — which the petitioner refers to as the environmental cost — was set for the business sector for 2021 at an average of 10 colones per cubic meter of water. On top of that, administrative, maintenance, investment, and other costs are added to arrive at the determination of the applicable rates according to use and volume. The minimum subsidized rate of the Instituto Costarricense de Acueductos y Alcantarillados for residents who use less than 16 m³ per month is 409 colones per m³.
The petitioner highlights ARESEP's oversight role. Ley n.° 7593 and its regulations granted powers to the Intendencia de Aguas. MINAE is a political entity and lacks a collegiate, representative body to exercise any oversight over its operation in water matters. The petitioner considers that the environmental cost criteria for water should be unified, as they must apply equally to any use to which the resource is put. The petitioner acknowledges, however, that it would not be easy to define this all at once. Recognizing, accepting, and distinguishing between legally defined priorities and those supported by technical criteria. The petitioner argues that it is not right for ordinary citizens, through the consumption of drinking water that has been declared a priority use, to subsidize large consumers — that is, large and powerful business operators who use it to conduct business or irrigate a golf course. The petitioner states that this will be a lengthy process, which the petitioner seeks to begin with the annulment of Articles 7 and 9 of Decreto Ejecutivo n.° 32868, as they represent the most extreme case of violation of the principles of equality and justice.
The petitioner argues that the discriminatory treatment is determined and evidenced by the difference in the amount of the water use fee for equal water flow (caudal) — one cubic meter — for agricultural use. A distinction is made among crops, privileging a few — rice, sugarcane, coffee, oil palm — under Article 7 of the challenged decree, or those who, by virtue of their location, are receiving the resource from the DRAT, in Cañas and Bagaces, benefiting under Article 9. The petitioner explains that the disparity in water prices is so enormously egregious that it results in the poorest and most vulnerable subsidizing the wealthy and powerful, even at the cost of being unable to pay their monthly water bill. The petitioner clarifies that the proposal is not to equalize the prices of water for human consumption with those for irrigation. The rates incorporate the cost of resource administration and other elements necessary for the transport and quality of the product. Water for human consumption represents approximately 10 percent of the water resource legally used in Costa Rica. Concessions (concesiones) to private parties account for 90% of water use. Of that, mainly 60% to 70% is used for irrigation, so the large monocultures are the greatest beneficiaries.
For this reason, greater oversight must be included — something that currently does not exist, the petitioner asserts — since in these concessions, meters (medidores) are not installed, which are a basic and logical element necessary for any oversight. The petitioner considers that this generates a significant inequality before the law between citizens who must pay their monthly bills based on their measured water flow, and large consumers who have no meters and still go without paying for years — they are delinquent concession holders (concesionarios morosos) — yet their service is never cut off. The petitioner considers that the situation is prone to abuse, and that meters should be part of the water use fee amount. It should not be permitted to grant a water concession (concesión de aguas) without the ability to measure the water flow actually used by the concession holder (concesionario). The petitioner demands that fees be charged for the installation of meters or flow meters (caudalímetros).
The petitioner adds that the success of this action has a secondary objective, which is to promote water conservation, as there is no better incentive for conservation than adjusting the cost for large consumers. The intention is not to halt or harm the current concession holders, but only to incentivize them to adopt new and proven irrigation technologies such as sprinkler, drip, misting, etc. This would generate significant reductions in the required water flow while achieving the same production. A small 10% reduction by those few consumers would produce savings equivalent to all the water currently used by the Instituto Costarricense de Acueductos y Alcantarillados throughout the country. What the petitioner seeks is for the water use fee to cover the environmental costs incurred by the Costa Rican State to protect the sustainability of the water resource, to ensure its continued existence for future generations, and for the use of this public good to benefit the entire country and serve as a foundation for productive development and economic recovery.
Based on the foregoing, the petitioner requests that a judgment (sentencia) be issued declaring the unconstitutionality of Articles 7 and 9 of Decreto Ejecutivo n.° 32868-MINAE and ordering their annulment, so that the different categories of agricultural use are equalized, as provided in Article 5 of the same decree. The petitioner also requests that the judgment determine whether the amounts not collected by the State on water flow in recent years should be charged. The petitioner further requests that the judgment declare the necessary application of the technical and legal criteria defined by ARESEP regarding the collection of an environmental rate (tarifa ambiental), and that the water use fee for concessions granted by MINAE be adjusted to those criteria within a maximum period of 6 months.
This action is admitted as it meets the requirements set forth in the Ley de la Jurisdicción Constitucional in its Articles 73 through 79. The petitioner's standing (legitimación) derives from Article 75, paragraph two, of the Ley de la Jurisdicción Constitucional, inasmuch as the petitioner invokes the defense of diffuse interests (intereses difusos), such as the principles of in dubio pro natura and in dubio pro aqua.

Legal effects of the filing of the action: the publication provided for in Section 81 of the Ley de la Jurisdicción Constitucional is intended to notify courts and administrative bodies that exhaust the administrative channel (vía administrativa) that a constitutional challenge (demanda de inconstitucionalidad) has been filed, so that in any proceedings in which the application of the law, decree, provision, agreement, or resolution is at issue, no final ruling shall be issued until the Sala has rendered its decision on the case. Several rules may be drawn from this legal provision. The first, and perhaps most important, is that the filing of an action of unconstitutionality (acción de inconstitucionalidad) does not suspend the general force and applicability of the challenged rules. ACTION OF UNCONSTITUTIONALITY PETITIONER:
ASOCIACION CONFRATERNIDAD GUANACASTECA CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at fifteen hours thirty-nine minutes on the ninth of February of two thousand twenty-two.
The constitutional challenge (acción de inconstitucionalidad) filed by [Nombre01 001], residence identification number [CED01], on behalf of the ASOCIACIÓN COFRATERNIDAD GUANACASTECA, legal entity identification number CED02, against Articles 7 and 9 of Decreto Ejecutivo n.° 32868, Canon por Concepto de Aprovechamiento de Aguas, published in La Gaceta n.° 21 of January 30, 2006, is admitted for processing, on the grounds that those articles are considered contrary to Articles 21, 33, and 50 of the Constitución Política. A fifteen-day hearing period is granted to the Attorney General of the Republic, to the Minister of the Presidency of the Republic, and to the Minister of Environment and Energy. The provisions are challenged insofar as they create a category of water users with unjustified privileges that are contrary to legitimate rights. This causes direct and indirect harm to others and has negative impacts on the priority of protecting public health and the national ecosystems.
The petitioner clarifies that the sole request is for a declaration of unconstitutionality and for the issuance of an interpretive ruling (sentencia interpretativa) that would equalize the various categories of agricultural water use, as defined and included in Article 5 of the same decree, under which those currently unjustly benefiting from the challenged Articles 7 and 9 would then be regulated. The challenged articles provide as follows: "Article 7.— In the case of water use for the irrigation (riego) of rice, sugarcane, pasture, coffee, and African palm crops, given that these are traditional extensive crops exposed to special market conditions, a fee of 0,12 colones per cubic meter per year shall be recognized for surface water held under concession (concesión) and 0,16 colones per cubic meter for groundwater held under concession." "Article 9.— Given the particular characteristics of the Distrito de Riego Arenal Tempisque (DRAT), within which a public irrigation service is provided by the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) under a water supply scheme conditioned on hydroelectric priority, SENARA shall pay a total water use fee (canon) of 0,12 colones per cubic meter per year, to be collected gradually as stipulated in the following Article 10." (Underlining by the petitioner.)
The petitioner considers that these two articles contravene the recitals (considerandos) of the same decree, as well as several current principles and laws, and that they violate the Constitución Política. All agricultural water uses can and should be equalized with those classified under Article 5 of the same decree. The petitioner notes that the connection between water, health, and the right to life enshrined in Article 21 of the Constitution is clear and indisputable. Human consumption must be the priority. Granting such privilege to economic agricultural use affects, in some areas, the quality, quantity, and availability of water for human consumption supply. This is particularly so because peak agricultural irrigation consumption occurs during the dry season, when water is most scarce in the aquifers (acuíferos).
The petitioner indicates that this constitutional challenge is grounded in the violation of the equality principle of Article 33, and challenges a clear act of discrimination in the management of a public asset (bien público) that is entirely under State control and is managed in a wholly unequal manner without any valid justification, thereby affecting the basic, essential, daily, and ordinary activities of the population, as well as the equitable development of other economic activities. The petitioner highlights the violations of Article 50 of the Constitución Política, particularly regarding the final paragraph, which provides: "Every person has the basic, inalienable human right of access to drinking water as an essential good for life. Water is a national asset, indispensable for protecting that human right. Its use, protection, sustainability, conservation, and exploitation shall be governed by the law to be created for these purposes, and the supply of drinking water for the consumption of individuals and communities shall take priority." In the petitioner's view, the economic dimension — be it cost, fee, tariff, investment, or revenue collection — is decisive in the provision, omission, or quality of a public service.
Without water there is no life. For this reason, the delivery of large quantities of water resources (recurso hídrico) at near-zero cost affects the costs and quality of service received by residents who need drinking water. The question is: is it fair and constitutional for the 10 percent of water allocated to human consumption to bear the costs of the 70 percent allocated to irrigation?
The petitioner argues that it is clear and indisputable that by discriminating according to crop type, as Article 7 — here challenged — does with rice, sugarcane, coffee, and African palm, an injustice is committed against small and medium-sized farmers of all other crops, without any solid technical justification. In the case of Article 9, also challenged, the principles set forth in the first paragraph of Article 50 of the Constitución Política are similarly and flagrantly violated, creating a geographic discrimination in favor of those located in the area of Dirección01— In general, 4 large sugarcane and rice farms. No effort is made to organize or stimulate the production of thousands of farmers dedicated to producing basic-basket (canasta básica) foods such as vegetables, fruits, tomatoes, onions, potatoes, beans, corn, and other crops of enormous importance to the health, lives, and economy of Costa Rica. Entirely contrary to the stated aim of "stimulating production and the most equitable distribution of wealth," what exists here is a blatant promotion of monocultures and an ever-greater concentration of wealth in very few hands.
As evidence of this claim, the petitioner submits several pages from the report on irrigation water concessions from the Río Tempisque in Guanacaste, where several concessions grant water use of more than 1,000 liters per second each, with one granted by MINAE to Central Azucarera Tempisque — CATSA standing out at a flow of 5,750 liters per second. And the same company holds additional concessions. As a point of comparison, the petitioner notes that the total drinking water consumed by the entire Province of Guanacaste — whether through aqueducts operated by the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) or through the hundreds of community ASADAS — is less than the 5,750 liters of flow granted by MINAE under this single concession. That is the reality of MINAE's mismanagement: granting concessions for enormous volumes of water at prices subsidized by the community.
Everyone, without any need for a university education or laboratory analysis, knows that the molecular composition of water is H2O. The popular saying simplifies this fact by stating "exactly like two drops of water." The difference between two drops of water is caused by external agents. Water can dissolve and carry various organic or chemical substances. There is saltwater, there is dirty water, there is water containing fecal coliforms, there is contaminated water, there is drinking water, there is chlorinated water, there is water solidified into ice or snow, there is water turned into vapor and clouds, and so on. In all cases, water remains water.
The petitioner argues that the vast difference in water cost between different users puts the most vulnerable and sensitive consumers at risk. Since water for human consumption has been declared a priority and a human right, and its absence puts the health and lives of inhabitants at risk, the petitioner invokes Article 21 of the Constitución Política. Eliminating this enormous disparity will help conserve and save water, making it sustainable. This will also make it easier for the responsible institutions to adequately fulfill the public drinking water service.
Equality before the law is a basic principle enshrined in the Constitución Política in Article 33, which states: "every person is equal before the law and no discrimination contrary to human dignity shall be practiced." In this case, the poorest residents, who consume less than 16 m³ per month in their homes and receive what is supposedly a subsidized water service through ICAA, pay a minimum cost of 409 colones per cubic meter. Against this backdrop, Azucarera el Viejo, owned by Mr. Álvaro Jenkins, CATSA, owned by Guatemalan businesspeople, and Ingenio Taboga, owned by the mbre02 and mbre03 families, which receive thousands of cubic meters every second of the day, pay only 14 centavos of a colón per m³.
Article 3 of that same decree states: "The water use fee contemplates the value of use and the environmental service of protection of water resources." The studies conducted in 2004, which provided the technical basis for defining the fee, support the values defined in Article 5 for agricultural and livestock use (uso agropecuario). Those studies never contemplated or justified the exceptions contained in the challenged Articles 7 and 9. These enormous privileges were granted through political arrangements to benefit groups of great economic and political power in Costa Rica. Namely coffee growers, sugarcane growers, rice growers, and a company producing oil and margarine. The sole argument put forward to justify these privileges appears in Article 7, which states "given that these are traditional extensive crops exposed to special market conditions." To maintain that oil palm should be considered a traditional crop is not at all accurate. Corn and beans surpass it in that category of traditional products and are not excluded. The characterization that these are extensive crops is correct. And it must be added that the majority is concentrated in few hands, in large landholdings (latifundios) or groups of related companies. And that may well have been the reason why the great benefit of inclusion in the privileged sector of the challenged Article 7 was granted.
As for the other stated parameter — "exposed to special market conditions" — the petitioner alleges that no study, law, or verified data is known to support this assertion. The argument "exposed to special market conditions" should be considered as unconnected to the setting of the irrigation water use fee. Other tools and bodies exist for that purpose, charged with overseeing competitiveness and the rules of the agricultural market. As an example, the petitioner cites a recent executive decree obtained by LAICA, which imposes a 73 percent tax on sugar imported into Costa Rica.
The petitioner considers that the privilege being challenged here is no small matter. In the original 2006 decree, for agricultural and livestock use under Article 5, the fee is set at 1.29 and 1.40 colones per m³. Under the challenged Articles 7 and 9, for agricultural use defined by crop type or geographic location, the fee is reduced to 12 and 16 centavos per m³. This represents a 90 percent difference. That is, some pay only 10 percent of the fee that the remaining farmers must bear. That difference is maintained with the updates applied to the fee (oficio DA-0071-2021).
The Distrito de Riego Arenal Tempisque (DRAT) is administered by SENARA. It is to this district that the challenged Article 9 — which the petitioner requests be struck down as unconstitutional — refers. SENARA should be considered an intermediary concession holder (concesionario) between MINAE, which grants the right, and the final irrigation water user. The petitioner states that it is important to highlight several points of analysis to understand the situation: the DRAT had essentially two main canals. The southern canal, which extended to Bebedero de Cañas, and the western canal, which covers the left bank of the Tempisque. The works of the western canal were constructed by COOPEVICA under a concession agreement (contrato de concierto) authorized and regulated by Decreto Ejecutivo n.° 28333-MAG.
COOPEVICA was established by public deed (escritura pública) in 2000 before notary Gastón Francisco Peralta Volio, by Gonzalea Alvarado of El Pelón de la Bajura, Álvaro Jenkins Morales of Inversiones Tonosi, Larry Stewwart Postel of Ganadera El Cortez S.A., and two other individuals. In exchange for these works, they reserved the right to use the water at no cost or payment for 10 years. The petitioner alleges that today, among the principal beneficiaries of the DRAT are grupo Taboga, Hacienda El Pelón, CATSA, and Azucarera el Viejo, each receiving approximately 3,000 liters per second. That is to say, this case once again involves some of the same beneficiaries as the other challenged article.
The petitioner argues that the egregious disparity among equals contravenes the fundamental principle of equality before the law, enshrined in Article 33 of the Constitution (Constitución Política). The equality violated in this case is twofold. Water is water; it is the same resource. The other violated equality is that between individuals or companies engaged in the same rural activity: agriculture. Differentiating between growers of corn and beans, or plantains, or carrots and potatoes, as opposed to those growing rice, sugarcane, or oil palm, is neither legally supported nor justified.
Furthermore, the petitioner also considers that Articles 7 and 9 grossly violate what is stated in Article 50 of the Constitution, which provides that "The State shall seek the greatest well-being for all inhabitants of the country, organizing and stimulating production and the best distribution of wealth." Articles 7 and 9, by granting an undeserved and unjustified privilege to those who operate large monoculture enterprises (monocultivos) and large landholdings (latifundios), completely contradict the foregoing. Favoring already powerful sectors of coffee, sugarcane, rice, and oil palm growers fosters the concentration of wealth. Furthermore, it unnecessarily harms other productive sectors that require water for irrigation of their crops.
The petitioners indicate that what they seek is for the water use fee (canon) to recover or collect on behalf of the State at least the environmental cost of water. Otherwise, an unsustainable subsidy or management regime is being accepted and legalized, to the detriment of current and future generations.
The environmental cost of water, or water resource protection fee (tarifa de protección del recurso hídrico), is the central point underlying this action. The environmental cost of water represents investment in the purchase and conservation of recharge areas (áreas de recarga) — national parks, private reserves, protected zones, and the channels of rivers and streams, lakes, estuaries, and other bodies of water — the fundamental maintenance of forests, and ensuring the entire natural cycle of the water resource. This has a cost, and the petitioner states that the reference authority on this matter is the Autoridad Reguladora de Servicios Públicos (Public Utilities Regulatory Authority), the public technical institution that defines costs and rates and oversees the proper management of the resource, pursuant to Ley n.° 7593 and its regulations. In the case of water, ARESEP has a water intendancy (intendencia de aguas) and has issued several resolutions defining the expenditure necessary to protect water for current and future generations' use.
The petitioner states that this is offered as an appropriate, valid, legal, current, technical, logical, recognized, and suitable reference point for drawing a comparison with what is being requested, thereby properly justifying the fairness of a ruling in favor of the claim. Accordingly, the petitioner submits as annexes resolución RE-0213-JD-2018 of December 4, 2018, the rate methodology for water resource protection, which defines the environmental cost of water and provides mathematical formulas for its calculation. Based on that methodology, ARESEP defined the water resource protection fee and applied it in resolución RE-0005-IA-2019 from expediente ET-087-2019, published in La Gaceta n.° 242 of December 19, 2019. In that resolution, the water resource protection fee — which the petitioner (accionante) terms the environmental cost — was set for the business sector for 2021 at an average of 10 colones per cubic meter of water. On top of that, administrative, maintenance, investment, and other costs are added to arrive at the prevailing rates according to use and volume. The minimum subsidized rate of the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) for residents who consume fewer than 16 m³ per month is 409 colones per m³.
The petitioner highlights ARESEP's regulatory function. Ley n.° 7593 and its regulations granted powers to the Intendencia de Aguas. MINAE is a political body and lacks a collegial, representative body that exercises any oversight over its water-related operations.
The petitioner considers that the criteria for the environmental cost of water should be unified, as they must apply equally to any use to which the resource is put. Although the petitioner acknowledges that it would not be easy to define all at once. This would involve recognizing, accepting, and distinguishing between legally defined priorities and those supported by technical criteria.
The petitioner states that it is not right for ordinary citizens, who consume drinking water declared a priority use, to subsidize large consumers — that is, large and powerful business interests who use water to run commercial operations or irrigate a golf course. The petitioner states that this will be a lengthy process, which the petitioner seeks to initiate through the annulment of Articles 7 and 9 of Decreto Ejecutivo n.° 32868, as these represent the most extreme case of violation of the principles of equality and justice.
The petitioner argues that the discriminatory treatment is determined and demonstrated by the difference in the amount of the water use fee for the same flow volume (caudal) — cubic meter — for agricultural use. A distinction is drawn between crops, privileging a few — rice, sugarcane, coffee, oil palm — under Article 7 of the challenged decree, or those that, by virtue of their location, receive the resource from the DRAT, in Cañas and Bagaces, as benefited by Article 9. The petitioner contends that the inequality in the price of water is so enormously disproportionate that it results in the poorest and most vulnerable subsidizing the wealthy and powerful, even at the cost of being unable to pay their monthly water bill.
The petitioner clarifies that there is no proposal to equate the prices of water for human consumption with those for irrigation. The rates include the cost of resource administration and other elements necessary for the transport and quality of the product. Water for human consumption represents approximately 10 percent of the water resource legally utilized in Costa Rica. Concessions to private parties account for 90% of the water. Of that, approximately 60% to 70% is used primarily for irrigation, meaning that large monoculture operations are the principal beneficiaries. For this reason, greater oversight must be incorporated — something that does not currently exist, as the petitioner affirms — since in these services, meters (medidores), a basic and logical element necessary for any oversight, are not installed.
The petitioner considers that this creates a significant inequality before the law between citizens who must pay their monthly bills according to the measured flow volume consumed and large consumers who have no meters, and who, despite going years without paying and being delinquent concession holders (concesionarios morosos), are not cut off from the service. The petitioner considers that the situation is prone to abuse, and that meters should be part of what the canon covers. A water concession should not be granted without the possibility of measuring the flow volume actually used by the concessionaire. The petitioner argues that charges should be levied for the installation of meters or flow meters (caudalímetros).
The petitioner adds that the success of this action has an underlying objective, which is to promote water conservation, since there is no better incentive for conservation than adjusting the cost for large consumers. The intention is not to halt or harm existing concession holders, but only to incentivize them to adopt new and proven irrigation technologies such as sprinkler, drip, and misting systems, among others. This would generate significant reductions in the required flow volume while achieving the same level of production. A modest 10% reduction by those few large consumers would yield savings equivalent to all the water currently used by ICAA throughout the entire country.
What the petitioner seeks is for the water use canon to cover the environmental costs incurred by the Costa Rican State in protecting the sustainability of the water resource, to ensure its availability for future generations, and for the use of this public good to benefit the entire country and serve as a foundation for productive development and economic recovery.
On the basis of the foregoing, the petitioner requests that the court issue a ruling declaring the unconstitutionality of Articles 7 and 9 of Decreto Ejecutivo n.° 32868-MINAE and ordering their annulment, so that the various categories of agricultural use be equalized, as is the case under Article 5 of the same decree. Additionally, that the ruling determine whether the State should collect the amounts left uncollected for flow volume used in recent years. The ruling should also declare the mandatory application of the legal and technical criteria defined by ARESEP regarding the collection of an environmental fee, and require that the canon for the use of waters granted in concession by MINAE be brought into conformity with those criteria within a maximum period of 6 months.

Se da curso a la acción de inconstitucionalidad interpuesta por [Nombre01 001], cédula de residencia n.° [CED01], en representación de la ASOCIACIÓN COFRATERNIDAD GUANACASTECA, cédula jurídica n.° CED02, contra los artículos 7 y 9 del Decreto Ejecutivo n.° 32868, Canon por Concepto de Aprovechamiento de Aguas, publicado en La Gaceta n.° 21 del 30 de enero de 2006, por estimarlos contrarios a los artículos 21, 33 y 50 de la Constitución Política . Los artículos impugnados disponen lo siguiente: "Artículo 7°- El caso del uso de agua para el riego de los cultivos de arroz, caña de azúcar, pastos, café y palma africana, por tratarse de cultivos extensivos tradicionales, expuestos a condiciones especiales de mercado, deberán reconocer un monto de 0,12 colones por metro cúbico anual de agua para agua superficial en concesión y 0,16 colones por metro cúbico de agua subterránea en concesión". "Artículo 9°- Dada la particularidad del distrito de Riego Arenal Tempisque (DRAT) dentro del cual se presta un servicio público de riego por parte del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) bajo un esquema de suministro de agua condicionado a la prioridad hidroeléctrica, el SENARA cancelará un valor total de canon de 0,12 colones por metro cúbico por año, que se cobrará gradualmente conforme lo estipula el artículo 10 siguiente" (El subrayado es del accionante).
Considera que estos dos artículos contravienen lo enunciado en los considerandos del mismo decreto y también varios principios y leyes vigentes y violentan la Constitución Política. Todos los usos agrícolas pueden y deben estar igualados a los clasificados en el artículo 5 del mismo decreto. Señala que es clara e indiscutible la relación del agua con la salud y el derecho a la vida, consagrado en el artículo 21 constitucional. La prioridad debe ser el consumo humano. El privilegiar tanto al uso económico en agricultura, afecta en algunas zonas la calidad, cantidad y disponibilidad del agua para abastecimiento del consumo humano. Principalmente, porque los picos de consumo en riego agrícola se dan en la temporada seca, cuando más falta hace el agua en los acuíferos. Indica que esta gestión de inconstitucionalidad se sustenta en la violación del principio de igualdad del artículo 33 e impugna una clara discriminación en el manejo de un bien público, que está totalmente en poder del Estado y que lo maneja en forma totalmente desigual y sin justificación válida alguna, afectando a las actividades básicas, imprescindibles, diarias y corrientes de la población y también el desarrollo equitativo de otras actividades económicas.
Las violaciones al artículo 50 de la Constitución Política las resalta, especialmente en cuanto al último párrafo, que dispone: "Toda persona tiene el derecho humano, básico e irrenunciable de acceso al agua potable, como bien esencial para la vida. El agua es un bien de la nación, indispensable para proteger tal derecho humano. Su uso, protección, sostenibilidad, conservación y explotación se regirá por lo que establezca la ley que se creará para estos efectos y tendrá prioridad el abastecimiento de agua potable para consumo de las personas y las poblaciones". En su criterio, el aspecto económico, llámese costo, canon, tarifa, inversión, recaudación, es determinante en la prestación, omisión o calidad de un servicio público. Sin agua no hay vida. Por esto, el entregar gran cantidad del recurso hídrico casi regalado, incide en los costos y calidad de servicio que reciben los pobladores, necesitados de agua potable.
La cuestión es ¿es justo y constitucional que el 10 por ciento del agua para consumo humano, pague los costos del 70 por ciento del agua para riego? Aduce que es claro e indiscutible que, al discriminar según tipo de cultivo, como lo hace el artículo 7 -aquí impugnado- con el arroz, la caña de azúcar, el café y palma africana; se comete una injusticia con los pequeños y medianos agricultores, de todos los demás cultivos, sin justificación técnica y sólida. En el caso del artículo 9 también impugnado, igualmente se violentan groseramente los principios enunciados en el párrafo primero del artículo 50 de la Constitución Política, creando una discriminación geográfica a favor de los que están ubicados en la zona del Distrito Riego Arenal Tempisque - SENARA. En general 4 grandes fincas de caña de azúcar y arroz. No se organiza ni se estimula la producción de miles de agricultores dedicados a producir alimentos de la canasta básica, como son las verduras, frutas, tomates, cebollas, papas, frijoles, maíz y otros cultivos de enorme importancia para la salud, la vida y la economía de Costa Rica.
Totalmente contrario a lo indicado de "estimular la producción y el más adecuado reparto de la riqueza", se está ante un descarado fomento de los monocultivos y de la mayor concentración de la riqueza en muy pocas manos. Como prueba de esa afirmación, indica que aporta unas hojas del informe de concesiones de riego con aguas del Río Tempisque en Guanacaste, donde hay varias que otorgan el disfrute del recurso hídrico de más de 1000 litros por segundo cada una y sobresale una otorgada por el MINAE a Central Azucarera Tempisque - CATSA por un caudal de 5750 litros por segundo. Y la misma empresa tiene otras. Como parámetro de comparación, señala que el total de agua potable consumido por toda la Provincia de Guanacaste, ya sea en acueductos operados por el Instituto Costarricense de Acueductos y Alcantarillados y sumados a los cientos de ASADAS comunitarias es menor a los 5750 litros de caudal entregado por MINAE en esta sola concesión.
Esa es la realidad del mal manejo del MINAE, entregando concesiones con enormes volúmenes de agua a precios subsidiados por la comunidad. Todo el mundo, sin necesidad de estudios universitarios, ni de análisis de laboratorio, sabe que la composición molecular del agua es H2O. El dicho popular simplifica este hecho, diciendo "igualito que dos gotas de agua". La diferencia entre dos gotas de agua es causada por agentes externos. El agua puede disolver y transportar diversas materias, orgánicas o químicas. Hay agua salada, hay agua sucia, hay agua con coliformes fecales, hay agua contaminada, hay agua potable, agua con cloro, hay agua solidificada en hielo o nieve, hay agua gasificada convertida en vapor y nubes etc. En todos los casos el agua sigue siendo agua. Aduce que la gran diferencia en el costo del agua entre los distintos usuarios, pone en riesgo a los consumidores más débiles y sensibles.
Dado que el agua para consumo humano está declarada prioridad y derecho humano y que su falta pone en riesgo la salud y la vida de los habitantes, es que invoca el artículo 21 de la Constitución Política. Acabar con esa abismal diferencia, ayudará al cuidado y ahorro del vital líquido para hacerlo sostenible. Así se facilita a las instituciones encargadas cumplir adecuadamente con el servicio público de agua potable. La igualdad ante la ley es un principio básico, consagrado en la Constitución Política en su artículo 33 que indica "toda persona es igual ante la ley y no podrá practicarse discriminación alguna contraria a la dignidad humana". En este caso, a los habitantes más pobres, que consumen en sus hogares menos de 16 m³ por mes y que reciben el servicio de agua supuestamente subsidiado a través del Instituto Costarricense de Acueductos y Alcantarillados, el costo mínimo de cada metro cúbico es de 409 colones.
Frente a esta realidad, Azucarera el Viejo propiedad del señor Álvaro Jenkins, CATSA propiedad de empresarios guatemaltecos e Ingenio Taboga propiedad de las familias Nombre02 y Nombre03, que reciben miles de metros cúbicos cada segundo del día, pagan solo 14 centavos de colon por m³. El artículo 3 de ese mismo decreto dice "El canon por concepto de aprovechamiento de aguas contempla el valor de uso y el servicio ambiental de protección al recurso hídrico". Los estudios realizados en 2004 y que dieron sustento técnico a la definición del canon, sustentan para el uso agropecuario los valores definidos en el artículo 5. Nunca contemplaron o justificaron las excepciones de los artículos 7 y 9 aquí cuestionados. Estos enormes privilegios se otorgaron por arreglos políticos para beneficiar a grupos de gran poder económico y político en Costa Rica. Llámese cafetaleros, cañeros, arroceros y una empresa productora de aceite y margarina.
El único argumento expuesto para justificar esos privilegios, están en el artículo 7 que dice "por tratarse de cultivos extensivos tradicionales, expuestos a condiciones especiales de mercado". Sostener que la palma aceitera deba considerarse cultivo tradicional, no es nada acertado. El maíz y el frijol la superan en esa categoría de productos tradicionales y no están excluidos. La categorización de que se trata de cultivos extensivos es correcta. Y a eso debe agregarse que la mayor parte se concentra en pocas manos, en grandes latifundios o grupos de sociedades relacionadas. Y puede que esa fue la causa del otorgamiento del gran beneficio de estar incluidos en el sector privilegiado del artículo 7 impugnado. En cuanto al otro parámetro argumentado "expuestos a condiciones especiales de mercado", alega que no conoce ningún estudio, ley o datos verificados que sustenten esta afirmación. El argumento "expuestos a condiciones especiales de mercado" debe considerarse como inconexo con la fijación del canon de agua para riego.
Para eso existen otras herramientas y órganos encargados de velar por la competitividad y reglas del mercado agrícola. Como ejemplo, indica que se tiene un reciente decreto ejecutivo logrado por la liga agroindustrial de la caña (LAICA) que le pone 73 por ciento de impuesto al azúcar importado a Costa Rica. Estima que el privilegio que aquí se cuestiona no es poca cosa. En el decreto original de 2006, para uso agropecuario, artículo 5, se fija un canon de 1.29 y 1.40 colón por m³. En los artículos 7 y 9 impugnados, al uso agrícola determinado por cultivo o por ubicación geográfica, se baja a 12 y 16 centavos por m³. Se trata de una diferencia del 90 por ciento. Es decir, unos pagan solo el 10 por ciento del canon al que deben hacer frente el resto de agricultores. Esa diferencia se mantiene con las actualizaciones aplicadas al canon (oficio DA-0071-2021). El Distrito de Riego Arenal Tempisque (DRAT) es administrado por SENARA.
A este se refiere el artículo 9 cuestionado por inconstitucional y que solicita sea derogado. El SENARA debe ser considerado un "concesionario" intermediario entre el MINAE que otorga el derecho y el usuario definitivo del agua para riego. Manifiesta que es importante apuntar varios elementos de juicio para entender la situación: el DRAT tenía básicamente dos canales principales. Canal del sur que llegaba hasta Bebedero de Cañas y canal oeste que cubre la margen izquierda del Tempisque. Las obras del canal oeste fueron construidas por COOPEVICA mediante un contrato de concierto autorizado y regulado por el Decreto Ejecutivo n.° 28333-MAG. COOPEVICA la constituyeron por escritura pública en el 2000 ante el notario Gastón Francisco Peralta Volio, los señores Gonzalea Alvarado de El Pelón de la Bajura, Álvaro Jenkins Morales de Inversiones Tonosi, Larry Stewwart Postel de Ganadera El Cortez S.Nombre04. y dos personas más.
A cambio de estas obras se reservaron el uso de las aguas sin costo o pago alguno por 10 años. Aduce que hoy entre los grandes beneficiarios del DRAT se encuentran grupo Taboga, Hacienda El Pelón, CATSA y Azucarera el Viejo, cada una con unos 3000 litros por segundo. Es decir, que se vuelve a tener en este caso a algunos de los mismos beneficiarios del otro artículo impugnado. Alega que la grosera diferencia entre iguales contraviene un principio básico de igualdad ante la ley, consagrado así en el artículo 33 de la Constitución Política. La igualdad violentada en este caso es doble. Agua es agua, se trata del mismo bien. La otra igualdad incumplida es entre personas o empresas dedicadas a la misma actividad rural, la agricultura. Diferenciar entre cultivadores de maíz y frijol, o de plátanos o de zanahorias y papas, frente a los de arroz, caña de azúcar o palma aceitera, no se sustenta ni justifica legalmente.
De otra parte, también considera que los artículos 7 y 9 violentan groseramente lo dicho en el artículo 50 de la Constitución Política cuando dice que "El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el mejor reparto de la riqueza". Los artículos 7 y 9, al otorgar un privilegio inmerecido e injustificado a quienes manejan grandes empresas de monocultivos y de grandes latifundios, contradice totalmente lo indicado. El preferir a sectores ya poderosos de cafetaleros, cañeros, arroceros y palma aceitera, propicia la concentración de la riqueza. Además, afecta y perjudica, innecesariamente a otros sectores productivos, que requieren el agua para riego de sus productos. Indican que lo que solicitan es que el canon recupere o cobre a favor del Estado, al menos el costo ambiental del agua. Caso contrario, se está aceptando y legalizando un subsidio o un manejo insostenible, en detrimento de los habitantes actuales y de futuras generaciones.
El costo ambiental del agua o tarifa de protección del recurso hídrico es el punto central que sustenta esta gestión. El costo ambiental del agua es inversión en compra y conservación de áreas de recarga -parques nacionales, reservas privadas, zonas protegidas y cauces de ríos y quebradas, lagos, esteros y demás-, mantener los bosques es fundamental, garantizar todo el ciclo natural del recurso hídrico. Esto tiene un costo y dice que su referencia en este tema es la Autoridad Reguladora de Servicios Públicos, que es la institución pública y técnica que define costos y tarifas, controla el correcto manejo del recurso, en base a lo indicado en la Ley n.° 7593 y sus reglamentos. En el caso del agua, la ARESEP tiene una intendencia de aguas y tiene varias resoluciones que definen el gasto que debe hacerse para cuidar el agua, para su uso y el de las generaciones futuras. Indica que aporta esto como elemento apropiado, válido, legal, vigente, técnico, lógico, reconocido, equivalente y apropiado; para hacer la comparación con lo que se está solicitando y así justificar apropiadamente la justicia de una resolución a favor de su pretensión.
Así aporta como anexos la resolución RE-0213-JD-2018 del 4 de diciembre de 2018, metodología tarifaria para la protección del recurso hídrico, define el costo ambiental del agua y aporta fórmulas matemáticas para su cálculo. Con base en esa metodología ARESEP definió la tarifa de protección del recurso hídrico y la aplicó en resolución RE-0005-IA-2019 del expediente ET-087-2019 publicada en La Gaceta n.° 242 del 19 de diciembre de 2019. En esa resolución la tarifa de protección del recurso hídrico -que el accionante denomina costo ambiental- se fija para el sector empresarial para el 2021 en un promedio de 10 colones por metro cúbico de agua. Después de eso se le carga los costos administrativos, de mantenimiento, de inversión y otros, para llegar a la determinación de las tarifas vigentes según uso y volumen. La tarifa mínima y subsidiada del Instituto Costarricense de Acueductos y Alcantarillados para los habitantes que usan menos de 16 m³ por mes es de 409 colones por m³.
Destaca la función de control de la ARESEP. La Ley n.° 7593 y su reglamento le otorgó potestades a la Intendencia de Aguas. El MINAE es un ente político y carece de un grupo colegiado y representativo, que ejerza algún control sobre su funcionamiento en cuestión de aguas. Considera que debe unificarse los criterios de costo ambiental del agua, pues eso debe aplicarse por igual para cualquier uso a que se destine el recurso. Aunque entiende que no sería fácil definirlo de una sola vez. Reconociendo, aceptando y diferenciando las prioridades definidas legalmente y otras sustentadas por criterios técnicos. Indica que no es correcto que el simple ciudadano, con el consumo de agua potable declarada prioritaria, subsidie a los grandes consumidores, es decir, a los grandes y poderosos empresarios, que la usan para hacer negocios o regar una cancha de golf. Manifiesta que ese será un largo proceso, que intenta iniciar con la anulación de los artículos 7 y 9 del Decreto Ejecutivo n.° 32868, por ser el caso más extremo de violación a los principios de igualdad y justicia.
Aduce que el trato discriminatorio se determina y comprueba en la diferencia en el monto del canon de agua para igual caudal -metro cúbico- para uso en agricultura. Se diferencia entre cultivos, privilegiando a unos pocos, arroz, caña de azúcar, café, palma aceitera, por el artículo 7 del decreto impugnado, o aquellos que por su ubicación estén recibiendo el recurso del DRAT, en Cañas y Bagaces, beneficiados por el artículo 9. Expone que la desigualdad de precio del agua es tan monstruosamente inmensa, que deviene en que los más pobres y necesitados, subvencionen a los ricos y poderosos, aún a costa de no poder pagar el recibo mensual del agua. Aclara que no está proponiendo igualar los precios de agua para consumo humano con los de riego. En las tarifas entra el costo de administración del recurso y otros elementos necesarios para el transporte y calidad del producto. El agua para consumo humano es aproximadamente el 10 por ciento del recurso hídrico aprovechado legalmente en Costa Rica.
Las concesiones a privados es el 90% del agua. Ahí se usa, principalmente en riego un 60% o 70%, de modo que son los grandes monocultivos los más beneficiados. Por esto, debe incluirse un mayor control, cosa que hoy no existe, lo cual asegura, pues en estos servicios no se instala medidores, elemento básico y lógico necesario para todo control. Considera que con esto se genera una importante desigualdad ante la ley para los ciudadanos que deben pagar mensualmente los recibos que le llegan, según el caudal medido y los grandes consumidores, que no tienen medidores y aun así no pagan por años, son concesionarios morosos, pero no se les corta el servicio. Considera que la situación se presta para abusos, los medidores deben ser parte del monto del canon. No debería permitirse que se otorgue una concesión de aguas, sin posibilidad de medir el caudal realmente usado por el concesionario. Reclama que se debe cobrar por la instalación de medidores o caudalímetros.
Agrega que el éxito de esta acción tiene un objetivo oculto, que es provocar el ahorro del agua, pues no hay mejor elemento para impulsar el ahorro que la adecuación del costo para los grandes consumidores. Su intención no es parar o perjudicar a los actuales concesionarios, solo incentivarlos para la introducción de nuevas y probadas tecnologías de riego como son aspersión, goteo, vaporización, etc. Eso generaría grandes reducciones del caudal necesario, pero logrando la misma producción. Un pequeño ahorro del 10% de esos pocos consumidores, produciría un ahorro equivalente a toda el agua que utiliza hoy el Instituto Costarricense de Acueductos y Alcantarillados en todo el país. Lo que pretende es que el canon de aprovechamiento de agua cubra los costos ambientales en que incurre el Estado costarricense para proteger la sostenibilidad del recurso hídrico, asegure su existencia para las futuras generaciones y que el uso de ese bien público redunde en provecho de todo el país y sea base al desarrollo productivo y la reactivación económica.
Con base en lo anterior, solicita que se declare en sentencia la inconstitucionalidad de los artículos 7 y 9 del Decreto Ejecutivo n.° 32868-MINAE y determinar su anulación, para que se iguale las distintas categorías de uso agrícola, tal como está en el artículo 5 del mismo decreto. También, que se decida en sentencia si debe cobrarse el monto dejado de percibir por el Estado por el caudal en los años recién pasados. Declarar en sentencia la necesaria aplicación de los criterios técnico-jurídicos, definidos por ARESEP referentes al cobro de una tarifa ambiental y adecuar el canon de aprovechamiento de aguas concesionadas por MINAE a esos criterios, en un plazo máximo de 6 meses. Esta acción se admite por reunir los requisitos a que se refiere la Ley de la Jurisdicción Constitucional en sus artículos 73 a 79. La legitimación del accionante proviene del artículo 75, párrafo segundo, de la Ley de la Jurisdicción Constitucional, toda vez que indica acudir en defensa de intereses difusos, como son los principios in dubio pro natura e in dubio pro aqua.
Publíquese por tres veces consecutivas un aviso en el Boletín Judicial sobre la interposición de la acción. Efectos jurídicos de la interposición de la acción: la publicación prevista en el numeral 81 de la Ley de la Jurisdicción Constitucional tiene por objeto poner en conocimiento de los tribunales y los órganos que agotan la vía administrativa, que la demanda de inconstitucionalidad ha sido establecida, a efectos de que en los procesos o procedimientos en que se discuta la aplicación de la ley, decreto, disposición, acuerdo o resolución, tampoco se dicte resolución final mientras la Sala no haya hecho pronunciamiento del caso. De este precepto legal se extraen varias reglas. La primera, y quizás la más importante, es que la interposición de una acción de inconstitucionalidad no suspende la eficacia y aplicabilidad en general de las normas. La segunda, es que solo se suspenden los actos de aplicación de las normas impugnadas por las autoridades judiciales en los procesos incoados ante ellas, o por las administrativas, en los procedimientos tendientes a agotar la vía administrativa, pero no su vigencia y aplicación en general.
La tercera es que –en principio-, en los casos de acción directa (como ocurre en la presente acción), no opera el efecto suspensivo de la interposición (véanse votos No. 537-91, 2019-11633, así como resoluciones dictadas en los expedientes números 2019-11022, 19-006416 y 19-015543 del Tribunal Constitucional). Dentro de los quince días posteriores a la primera publicación del citado aviso, podrán apersonarse quienes figuren como partes en asuntos pendientes a la fecha de interposición de esta acción, en los que se discuta la aplicación de lo impugnado o aquellos con interés legítimo, a fin de coadyuvar en cuanto a su procedencia o improcedencia, o para ampliar, en su caso, los motivos de inconstitucionalidad en relación con el asunto que les interese. Se hace saber además, que de conformidad con los artículos 81 y 82 de la Ley de Jurisdicción Constitucional y conforme lo ha resuelto en forma reiterada la Sala (resoluciones 0536-91, 0537-91, 0554-91 y 0881-91) esta publicación no suspende la vigencia de la norma en general, sino únicamente su aplicación en los casos y condiciones señaladas.
La contestación a la audiencia conferida en esta resolución deberá ser presentada una única vez, utilizando solo uno de los siguientes medios: documentación física presentada directamente en la Secretaría de la Sala; el sistema de fax; documentación electrónica por medio del Sistema de GESTIÓN EN LÍNEA; o bien, a la dirección de correo electrónico ...01 , la cual es correo exclusivo dedicado a la recepción de informes. En cualquiera de los casos, la contestación y demás documentos deberán indicar de manera expresa el número de expediente al cual van dirigidos. La contestación que se rindan por medios electrónicos, deberá consignar la firma de la persona responsable que lo suscribe, ya sea digitalizando el documento físico que contenga su firma, o por medio de la firma digital, según las disposiciones establecidas en la Ley de Certificados, Firmas Digitales y Documentos Electrónicos, Nº 8454, a efectos de acreditar la autenticidad de la gestión.
Se advierte que los documentos generados electrónicamente o digitalizados que se presenten por el Sistema de Gestión en Línea o por el correo electrónico señalado, no deberán superar los 3 Megabytes. Notifíquese.
*220013720007CO* ACCIÓN DE INCONSTITUCIONALIDAD ASOCIACION CONFRATERNIDAD GUANACASTECA SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las quince horas treinta y nueve minutos del nueve de febrero de dos mil veintidós.
Se da curso a la acción de inconstitucionalidad interpuesta por [Nombre01 001], cédula de residencia n.° [CED01], en representación de la ASOCIACIÓN COFRATERNIDAD GUANACASTECA, cédula jurídica n.° CED02, contra los artículos 7 y 9 del Decreto Ejecutivo n.° 32868, Canon por Concepto de Aprovechamiento de Aguas, publicado en La Gaceta n.° 21 del 30 de enero de 2006, por estimarlos contrarios a los artículos 21, 33 y 50 de la Constitución Política . Se confiere audiencia por quince días al procurador General de la República, a la ministra de la Presidencia de la República y a la ministra de Ambiente y Energía . Las normas se impugnan en cuanto crean una categoría de usuarios de agua con privilegios injustificados y contrarios al legítimo derecho. En perjuicio directo e indirecto para otros y con impactos negativos sobre la prioridad de proteger la salud de las personas y los ecosistemas nacionales.
Aclara que solo se solicita que se declare la inconstitucionalidad y que se emita una sentencia interpretativa para que se iguale las distintas categorías de uso agrícola, tal como está definido e incluido en el artículo 5 del mismo decreto, donde quedarían regulados los actuales beneficiados injustamente por los artículos 7 y 9 cuestionados. Considera que estos dos artículos contravienen lo enunciado en los considerandos del mismo decreto y también varios principios y leyes vigentes y violentan la Constitución Política. Señala que es clara e indiscutible la relación del agua con la salud y el derecho a la vida, consagrado en el artículo 21 constitucional. La prioridad debe ser el consumo humano. El privilegiar tanto al uso económico en agricultura, afecta en algunas zonas la calidad, cantidad y disponibilidad del agua para abastecimiento del consumo humano. Principalmente, porque los picos de consumo en riego agrícola se dan en la temporada seca, cuando más falta hace el agua en los acuíferos. Indica que esta gestión de inconstitucionalidad se sustenta en la violación del principio de igualdad del artículo 33 e impugna una clara discriminación en el manejo de un bien público, que está totalmente en poder del Estado y que lo maneja en forma totalmente desigual y sin justificación válida alguna, afectando a las actividades básicas, imprescindibles, diarias y corrientes de la población y también el desarrollo equitativo de otras actividades económicas.
Las violaciones al artículo 50 de la Constitución Política las resalta, especialmente en cuanto al último párrafo, que dispone: "Toda persona tiene el derecho humano, básico e irrenunciable de acceso al agua potable, como bien esencial para la vida. El agua es un bien de la nación, indispensable para proteger tal derecho humano. Su uso, protección, sostenibilidad, conservación y explotación se regirá por lo que establezca la ley que se creará para estos efectos y tendrá prioridad el abastecimiento de agua potable para consumo de las personas y las poblaciones". En su criterio, el aspecto económico, llámese costo, canon, tarifa, inversión, recaudación, es determinante en la prestación, omisión o calidad de un servicio público. Sin agua no hay vida. Por esto, el entregar gran cantidad del recurso hídrico casi regalado, incide en los costos y calidad de servicio que reciben los pobladores, necesitados de agua potable.
La cuestión es ¿es justo y constitucional que el 10 por ciento del agua para consumo humano, pague los costos del 70 por ciento del agua para riego? Aduce que es claro e indiscutible que, al discriminar según tipo de cultivo, como lo hace el artículo 7 -aquí impugnado- con el arroz, la caña de azúcar, el café y palma africana; se comete una injusticia con los pequeños y medianos agricultores, de todos los demás cultivos, sin justificación técnica y sólida. En el caso del artículo 9 también impugnado, igualmente se violentan groseramente los principios enunciados en el párrafo primero del artículo 50 de la Constitución Política, creando una discriminación geográfica a favor de los que están ubicados en la zona del Dirección01- En general 4 grandes fincas de caña de azúcar y arroz. No se organiza ni se estimula la producción de miles de agricultores dedicados a producir alimentos de la canasta básica, como son las verduras, frutas, tomates, cebollas, papas, frijoles, maíz y otros cultivos de enorme importancia para la salud, la vida y la economía de Costa Rica.
Totalmente contrario a lo indicado de "estimular la producción y el más adecuado reparto de la riqueza", se está ante un descarado fomento de los monocultivos y de la mayor concentración de la riqueza en muy pocas manos. Como prueba de esa afirmación, indica que aporta unas hojas del informe de concesiones de riego con aguas del Río Tempisque en Guanacaste, donde hay varias que otorgan el disfrute del recurso hídrico de más de 1000 litros por segundo cada una y sobresale una otorgada por el MINAE a Central Azucarera Tempisque - CATSA por un caudal de 5750 litros por segundo. Y la misma empresa tiene otras. Como parámetro de comparación, señala que el total de agua potable consumido por toda la Provincia de Guanacaste, ya sea en acueductos operados por el Instituto Costarricense de Acueductos y Alcantarillados y sumados a los cientos de ASADAS comunitarias es menor a los 5750 litros de caudal entregado por MINAE en esta sola concesión.
Esa es la realidad del mal manejo del MINAE, entregando concesiones con enormes volúmenes de agua a precios subsidiados por la comunidad. Todo el mundo, sin necesidad de estudios universitarios, ni de análisis de laboratorio, sabe que la composición molecular del agua es H2O. El dicho popular simplifica este hecho, diciendo "igualito que dos gotas de agua". La diferencia entre dos gotas de agua es causada por agentes externos. El agua puede disolver y transportar diversas materias, orgánicas o químicas. Hay agua salada, hay agua sucia, hay agua con coliformes fecales, hay agua contaminada, hay agua potable, agua con cloro, hay agua solidificada en hielo o nieve, hay agua gasificada convertida en vapor y nubes etc. En todos los casos el agua sigue siendo agua. Aduce que la gran diferencia en el costo del agua entre los distintos usuarios, pone en riesgo a los consumidores más débiles y sensibles.
Dado que el agua para consumo humano está declarada prioridad y derecho humano y que su falta pone en riesgo la salud y la vida de los habitantes, es que invoca el artículo 21 de la Constitución Política. Acabar con esa abismal diferencia, ayudará al cuidado y ahorro del vital líquido para hacerlo sostenible. Así se facilita a las instituciones encargadas cumplir adecuadamente con el servicio público de agua potable. La igualdad ante la ley es un principio básico, consagrado en la Constitución Política en su artículo 33 que indica "toda persona es igual ante la ley y no podrá practicarse discriminación alguna contraria a la dignidad humana". En este caso, a los habitantes más pobres, que consumen en sus hogares menos de 16 m³ por mes y que reciben el servicio de agua supuestamente subsidiado a través del Instituto Costarricense de Acueductos y Alcantarillados, el costo mínimo de cada metro cúbico es de 409 colones.
Frente a esta realidad, Azucarera el Viejo propiedad del señor Álvaro Jenkins, CATSA propiedad de empresarios guatemaltecos e Ingenio Taboga propiedad de las familias mbre02 y y mbre03, , que reciben miles de metros cúbicos cada segundo del día, pagan solo 14 centavos de colon por m³. El artículo 3 de ese mismo decreto dice "El canon por concepto de aprovechamiento de aguas contempla el valor de uso y el servicio ambiental de protección al recurso hídrico". Los estudios realizados en 2004 y que dieron sustento técnico a la definición del canon, sustentan para el uso agropecuario los valores definidos en el artículo 5. Nunca contemplaron o justificaron las excepciones de los artículos 7 y 9 aquí cuestionados. Estos enormes privilegios se otorgaron por arreglos políticos para beneficiar a grupos de gran poder económico y político en Costa Rica. Llámese cafetaleros, cañeros, arroceros y una empresa productora de aceite y margarina.
El único argumento expuesto para justificar esos privilegios, están en el artículo 7 que dice "por tratarse de cultivos extensivos tradicionales, expuestos a condiciones especiales de mercado". Sostener que la palma aceitera deba considerarse cultivo tradicional, no es nada acertado. El maíz y el frijol la superan en esa categoría de productos tradicionales y no están excluidos. La categorización de que se trata de cultivos extensivos es correcta. Y a eso debe agregarse que la mayor parte se concentra en pocas manos, en grandes latifundios o grupos de sociedades relacionadas. Y puede que esa fue la causa del otorgamiento del gran beneficio de estar incluidos en el sector privilegiado del artículo 7 impugnado. En cuanto al otro parámetro argumentado "expuestos a condiciones especiales de mercado", alega que no conoce ningún estudio, ley o datos verificados que sustenten esta afirmación. El argumento "expuestos a condiciones especiales de mercado" debe considerarse como inconexo con la fijación del canon de agua para riego.
Para eso existen otras herramientas y órganos encargados de velar por la competitividad y reglas del mercado agrícola. Como ejemplo, indica que se tiene un reciente decreto ejecutivo logrado por la liga agroindustrial de la caña (LAICA) que le pone 73 por ciento de impuesto al azúcar importado a Costa Rica. Estima que el privilegio que aquí se cuestiona no es poca cosa. En el decreto original de 2006, para uso agropecuario, artículo 5, se fija un canon de 1.29 y 1.40 colón por m³. En los artículos 7 y 9 impugnados, al uso agrícola determinado por cultivo o por ubicación geográfica, se baja a 12 y 16 centavos por m³. Se trata de una diferencia del 90 por ciento. Es decir, unos pagan solo el 10 por ciento del canon al que deben hacer frente el resto de agricultores. Esa diferencia se mantiene con las actualizaciones aplicadas al canon (oficio DA-0071-2021). El Distrito de Riego Arenal Tempisque (DRAT) es administrado por SENARA.
A este se refiere el artículo 9 cuestionado por inconstitucional y que solicita sea derogado. El SENARA debe ser considerado un "concesionario" intermediario entre el MINAE que otorga el derecho y el usuario definitivo del agua para riego. Manifiesta que es importante apuntar varios elementos de juicio para entender la situación: el DRAT tenía básicamente dos canales principales. Canal del sur que llegaba hasta Bebedero de Cañas y canal oeste que cubre la margen izquierda del Tempisque. Las obras del canal oeste fueron construidas por COOPEVICA mediante un contrato de concierto autorizado y regulado por el Decreto Ejecutivo n.° 28333-MAG. COOPEVICA la constituyeron por escritura pública en el 2000 ante el notario Gastón Francisco Peralta Volio, los señores Gonzalea Alvarado de El Pelón de la Bajura, Álvaro Jenkins Morales de Inversiones Tonosi, Larry Stewwart Postel de Ganadera El Cortez S.A. y dos personas más.
A cambio de estas obras se reservaron el uso de las aguas sin costo o pago alguno por 10 años. Aduce que hoy entre los grandes beneficiarios del DRAT se encuentran grupo Taboga, Hacienda El Pelón, CATSA y Azucarera el Viejo, cada una con unos 3000 litros por segundo. Es decir, que se vuelve a tener en este caso a algunos de los mismos beneficiarios del otro artículo impugnado. Alega que la grosera diferencia entre iguales contraviene un principio básico de igualdad ante la ley, consagrado así en el artículo 33 de la Constitución Política. La igualdad violentada en este caso es doble. Agua es agua, se trata del mismo bien. La otra igualdad incumplida es entre personas o empresas dedicadas a la misma actividad rural, la agricultura. Diferenciar entre cultivadores de maíz y frijol, o de plátanos o de zanahorias y papas, frente a los de arroz, caña de azúcar o palma aceitera, no se sustenta ni justifica legalmente.
De otra parte, también considera que los artículos 7 y 9 violentan groseramente lo dicho en el artículo 50 de la Constitución Política cuando dice que "El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el mejor reparto de la riqueza". Los artículos 7 y 9, al otorgar un privilegio inmerecido e injustificado a quienes manejan grandes empresas de monocultivos y de grandes latifundios, contradice totalmente lo indicado. El preferir a sectores ya poderosos de cafetaleros, cañeros, arroceros y palma aceitera, propicia la concentración de la riqueza. Además, afecta y perjudica, innecesariamente a otros sectores productivos, que requieren el agua para riego de sus productos. Indican que lo que solicitan es que el canon recupere o cobre a favor del Estado, al menos el costo ambiental del agua. Caso contrario, se está aceptando y legalizando un subsidio o un manejo insostenible, en detrimento de los habitantes actuales y de futuras generaciones.
El costo ambiental del agua o tarifa de protección del recurso hídrico es el punto central que sustenta esta gestión. El costo ambiental del agua es inversión en compra y conservación de áreas de recarga -parques nacionales, reservas privadas, zonas protegidas y cauces de ríos y quebradas, lagos, esteros y demás-, mantener los bosques es fundamental, garantizar todo el ciclo natural del recurso hídrico. Esto tiene un costo y dice que su referencia en este tema es la Autoridad Reguladora de Servicios Públicos, que es la institución pública y técnica que define costos y tarifas, controla el correcto manejo del recurso, en base a lo indicado en la Ley n.° 7593 y sus reglamentos. En el caso del agua, la ARESEP tiene una intendencia de aguas y tiene varias resoluciones que definen el gasto que debe hacerse para cuidar el agua, para su uso y el de las generaciones futuras. Indica que aporta esto como elemento apropiado, válido, legal, vigente, técnico, lógico, reconocido, equivalente y apropiado; para hacer la comparación con lo que se está solicitando y así justificar apropiadamente la justicia de una resolución a favor de su pretensión.
Así aporta como anexos la resolución RE-0213-JD-2018 del 4 de diciembre de 2018, metodología tarifaria para la protección del recurso hídrico, define el costo ambiental del agua y aporta fórmulas matemáticas para su cálculo. Con base en esa metodología ARESEP definió la tarifa de protección del recurso hídrico y la aplicó en resolución RE-0005-IA-2019 del expediente ET-087-2019 publicada en La Gaceta n.° 242 del 19 de diciembre de 2019. En esa resolución la tarifa de protección del recurso hídrico -que el accionante denomina costo ambiental- se fija para el sector empresarial para el 2021 en un promedio de 10 colones por metro cúbico de agua. Después de eso se le carga los costos administrativos, de mantenimiento, de inversión y otros, para llegar a la determinación de las tarifas vigentes según uso y volumen. La tarifa mínima y subsidiada del Instituto Costarricense de Acueductos y Alcantarillados para los habitantes que usan menos de 16 m³ por mes es de 409 colones por m³.
Destaca la función de control de la ARESEP. La Ley n.° 7593 y su reglamento le otorgó potestades a la Intendencia de Aguas. El MINAE es un ente político y carece de un grupo colegiado y representativo, que ejerza algún control sobre su funcionamiento en cuestión de aguas. Considera que debe unificarse los criterios de costo ambiental del agua, pues eso debe aplicarse por igual para cualquier uso a que se destine el recurso. Aunque entiende que no sería fácil definirlo de una sola vez. Reconociendo, aceptando y diferenciando las prioridades definidas legalmente y otras sustentadas por criterios técnicos. Indica que no es correcto que el simple ciudadano, con el consumo de agua potable declarada prioritaria, subsidie a los grandes consumidores, es decir, a los grandes y poderosos empresarios, que la usan para hacer negocios o regar una cancha de golf. Manifiesta que ese será un largo proceso, que intenta iniciar con la anulación de los artículos 7 y 9 del Decreto Ejecutivo n.° 32868, por ser el caso más extremo de violación a los principios de igualdad y justicia.
Aduce que el trato discriminatorio se determina y comprueba en la diferencia en el monto del canon de agua para igual caudal -metro cúbico- para uso en agricultura. Se diferencia entre cultivos, privilegiando a unos pocos, arroz, caña de azúcar, café, palma aceitera, por el artículo 7 del decreto impugnado, o aquellos que por su ubicación estén recibiendo el recurso del DRAT, en Cañas y Bagaces, beneficiados por el artículo 9. Expone que la desigualdad de precio del agua es tan monstruosamente inmensa, que deviene en que los más pobres y necesitados, subvencionen a los ricos y poderosos, aún a costa de no poder pagar el recibo mensual del agua. Aclara que no está proponiendo igualar los precios de agua para consumo humano con los de riego. En las tarifas entra el costo de administración del recurso y otros elementos necesarios para el transporte y calidad del producto. El agua para consumo humano es aproximadamente el 10 por ciento del recurso hídrico aprovechado legalmente en Costa Rica.
Las concesiones a privados es el 90% del agua. Ahí se usa, principalmente en riego un 60% o 70%, de modo que son los grandes monocultivos los más beneficiados. Por esto, debe incluirse un mayor control, cosa que hoy no existe, lo cual asegura, pues en estos servicios no se instala medidores, elemento básico y lógico necesario para todo control. Considera que con esto se genera una importante desigualdad ante la ley para los ciudadanos que deben pagar mensualmente los recibos que le llegan, según el caudal medido y los grandes consumidores, que no tienen medidores y aun así no pagan por años, son concesionarios morosos, pero no se les corta el servicio. Considera que la situación se presta para abusos, los medidores deben ser parte del monto del canon. No debería permitirse que se otorgue una concesión de aguas, sin posibilidad de medir el caudal realmente usado por el concesionario. Reclama que se debe cobrar por la instalación de medidores o caudalímetros.
Agrega que el éxito de esta acción tiene un objetivo oculto, que es provocar el ahorro del agua, pues no hay mejor elemento para impulsar el ahorro que la adecuación del costo para los grandes consumidores. Su intención no es parar o perjudicar a los actuales concesionarios, solo incentivarlos para la introducción de nuevas y probadas tecnologías de riego como son aspersión, goteo, vaporización, etc. Eso generaría grandes reducciones del caudal necesario, pero logrando la misma producción. Un pequeño ahorro del 10% de esos pocos consumidores, produciría un ahorro equivalente a toda el agua que utiliza hoy el Instituto Costarricense de Acueductos y Alcantarillados en todo el país. Lo que pretende es que el canon de aprovechamiento de agua cubra los costos ambientales en que incurre el Estado costarricense para proteger la sostenibilidad del recurso hídrico, asegure su existencia para las futuras generaciones y que el uso de ese bien público redunde en provecho de todo el país y sea base al desarrollo productivo y la reactivación económica.
Con base en lo anterior, solicita que se declare en sentencia la inconstitucionalidad de los artículos 7 y 9 del Decreto Ejecutivo n.° 32868-MINAE y determinar su anulación, para que se iguale las distintas categorías de uso agrícola, tal como está en el artículo 5 del mismo decreto. También, que se decida en sentencia si debe cobrarse el monto dejado de percibir por el Estado por el caudal en los años recién pasados. Declarar en sentencia la necesaria aplicación de los criterios técnico-jurídicos, definidos por ARESEP referentes al cobro de una tarifa ambiental y adecuar el canon de aprovechamiento de aguas concesionadas por MINAE a esos criterios, en un plazo máximo de 6 meses. Esta acción se admite por reunir los requisitos a que se refiere la Ley de la Jurisdicción Constitucional en sus artículos 73 a 79. La legitimación del accionante proviene del artículo 75, párrafo segundo, de la Ley de la Jurisdicción Constitucional, toda vez que indica acudir en defensa de intereses difusos, como son los principios in dubio pro natura e in dubio pro aqua.
Publíquese por tres veces consecutivas un aviso en el Boletín Judicial sobre la interposición de la acción. Efectos jurídicos de la interposición de la acción: la publicación prevista en el numeral 81 de la Ley de la Jurisdicción Constitucional tiene por objeto poner en conocimiento de los tribunales y los órganos que agotan la vía administrativa, que la demanda de inconstitucionalidad ha sido establecida, a efectos de que en los procesos o procedimientos en que se discuta la aplicación de la ley, decreto, disposición, acuerdo o resolución, tampoco se dicte resolución final mientras la Sala no haya hecho pronunciamiento del caso. De este precepto legal se extraen varias reglas. La primera, y quizás la más importante, es que la interposición de una acción de inconstitucionalidad no suspende la eficacia y aplicabilidad en general de las normas. La segunda, es que solo se suspenden los actos de aplicación de las normas impugnadas por las autoridades judiciales en los procesos incoados ante ellas, o por las administrativas, en los procedimientos tendientes a agotar la vía administrativa, pero no su vigencia y aplicación en general.
La tercera es que –en principio-, en los casos de acción directa (como ocurre en la presente acción), no opera el efecto suspensivo de la interposición (véanse votos No. 537-91, 2019-11633, así como resoluciones dictadas en los expedientes números 2019-11022, 19-006416 y 19-015543 del Tribunal Constitucional). Dentro de los quince días posteriores a la primera publicación del citado aviso, podrán apersonarse quienes figuren como partes en asuntos pendientes a la fecha de interposición de esta acción, en los que se discuta la aplicación de lo impugnado o aquellos con interés legítimo, a fin de coadyuvar en cuanto a su procedencia o improcedencia, o para ampliar, en su caso, los motivos de inconstitucionalidad en relación con el asunto que les interese. Se hace saber además, que de conformidad con los artículos 81 y 82 de la Ley de Jurisdicción Constitucional y conforme lo ha resuelto en forma reiterada la Sala (resoluciones 0536-91, 0537-91, 0554-91 y 0881-91) esta publicación no suspende la vigencia de la norma en general, sino únicamente su aplicación en los casos y condiciones señaladas.
La contestación a la audiencia conferida en esta resolución deberá ser presentada una única vez, utilizando solo uno de los siguientes medios: documentación física presentada directamente en la Secretaría de la Sala; el sistema de fax; documentación electrónica por medio del Sistema de GESTIÓN EN LÍNEA; o bien, a la dirección de correo electrónico ...01 , la cual es correo exclusivo dedicado a la recepción de informes. En cualquiera de los casos, la contestación y demás documentos deberán indicar de manera expresa el número de expediente al cual van dirigidos. La contestación que se rindan por medios electrónicos, deberá consignar la firma de la persona responsable que lo suscribe, ya sea digitalizando el documento físico que contenga su firma, o por medio de la firma digital, según las disposiciones establecidas en la Ley de Certificados, Firmas Digitales y Documentos Electrónicos, Nº 8454, a efectos de acreditar la autenticidad de la gestión.
Se advierte que los documentos generados electrónicamente o digitalizados que se presenten por el Sistema de Gestión en Línea o por el correo electrónico señalado, no deberán superar los 3 Megabytes. Notifíquese.
