*210182740007CO* Ruling No. 2022001023 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty minutes on the fourteenth of January of two thousand twenty-two.

Amparo petition (recurso de amparo) filed by [Nombre01 001], of legal age, in a common-law union, management assistant, identity card [CED01], resident of Matina, on behalf of the Residents' Group of 23 Millas de Matina de Limón, against the Mayor (Alcalde) and the President of the Municipal Council (Concejo), both of the Municipality of Matina.

Background:

  1. 1By written submission received at the Secretariat of the Chamber at 09:53 hours on September 16, 2021, the petitioner files an amparo petition against the Mayor and the President of the Municipal Council, both of Matina, and states that on July 22, 2021, her community experienced a severe flood that left it cut off from the outside, and moreover, local residents suffered irreparable economic losses. She reports that the banana plantation (finca bananera) Limonfrut C has for a long time been constructing and expanding a levee (dique) along its boundary with 23 Millas, in full view and with the acquiescence of the respondent Municipality. Although the work is intended to protect the plantation, it also exposes the population to imminent danger, since her community is enclosed by earthen walls, meaning that "in future floods the water level will be even higher, and with this the danger faced by the inhabitants will be even greater." She argues that on October 10, 2008, the community of 23 Millas de Matina submitted a written concern to the Municipality regarding the raising of the levee, on the grounds that it entailed more risks than benefits.They also requested to be informed whether permits had been granted for that construction. On October 19, 2009, almost a year later, a group of residents delivered another document to the municipal body in the same terms, without having received any reply to either submission to date. She asserts that on February 26, 2010, she was compelled to file an amparo petition processed under case file 10-002951-0007-CO, in which the Chamber granted the petition; however, the order contained in the ruling of 08:44 hours of April 30, 2010, was never complied with by the respondent Municipality. She requests that the respondent municipality be ordered to suspend the works on the levee and proceed with the demolition of what has already been built, in order to safeguard the integrity of the inhabitants of the community of 23 Millas. For the foregoing reasons, she contends that the actions of the respondent authorities violated fundamental rights.
  2. 2By ruling of 14:32 hours on September 16, 2021, the Presidency of the Chamber admitted this amparo petition and requested a report from the Mayor and the President of the Municipal Council, both of Matina, concerning the facts alleged by the petitioner.
  3. 3Walter Céspedes Salazar, in his capacity as Mayor of Matina, submits a sworn report (written submission presented at 16:03 hours on September 24, 2021), attaching official memorandum UTGVM-PRS-044-2021, dated September 24, 2021, through which Mr. Bryan Navarro Hernández, Social Promoter of the Municipal Road Management Technical Unit (Unidad Técnica de Gestión Vial Municipal) of that municipality, and Engineer José Manuel Lee Obando, Assistant of that Unit, render the corresponding report. That document states the following: "in accordance with a situation arising in the community of 23 Millas (in response to the amparo petition under case file 21-018274-0007-CO, at the request for information from MBA. Johnny Rodríguez (Municipal Manager) and Licenciado Ricardo Sossa (legal advisor of the Municipality of Matina)), on September 23 of this year, we visited the site. It is important to inform you of the location of the site where the events reported in the amparo petition took place; for a clearer indication, a sketch map (croquis) is attached: (…) At the site, a survey was conducted using an unmanned aerial vehicle (aeronave no tripulada) (drone) in order to obtain photogrammetry (fotogrametría) data, with a view to generating this report and providing an important input; a survey of approximately 4.5 hectares was carried out, yielding the following area: (…) A channel flowing toward the community of 23 Millas is observed at the site; it is apparently an existing channel in which signs of cleaning works are indeed visible; however, the condition prior to this visit is unknown.It is presumed that the volume of water passing through the site caused an increase in sediment in the channel due to recent flooding. Nevertheless, this inquiry must be directed to the banana company; it must be made clear and emphatic that our department has no record of levees or constructions of this type, given that our primary function is the maintenance and upkeep of roads on the Cantonal Road Network (Red Vial Cantonal) (RVC). From this point, the following channel cross-section (sección transversal) profile is generated for the relevant analysis: (…) From the preceding image, it can be observed that the channel has a bottom width of approximately 4 meters, with earthen embankments on both sides, for a total width of approximately 35 meters. It should be emphasized that the section being analyzed is the red line in Illustration 3, with a cross-sectional distance of 83.5 meters. A cross-section of the channel is analyzed at a stretch near the dwellings adjacent to the channel in 23 Millas (as it is the location reported in the amparo petition); this stretch runs through the banana plantation and serves as drainage for the southern sector of Dirección01, facing the community of 23 Millas, yielding a new profile that was analyzed to determine whether the conditions of Illustration 3 are maintained, with the following result: (…) In this section (Illustration 4), a line is drawn (shown in red) corresponding to 62.5 meters (cross-section of the channel); from the same data it can be deduced that the embankment of material adjacent to the banana plantation is approximately 2 meters lower than the elevation of the town of 23 Millas.This last point is very important, because although this entire sector of Matina corresponds to a flood plain (llanura de inundación), a difference of approximately 2 meters makes the northeastern area of Illustration 4 a sector more prone to receiving water in the event of flooding. Another particular feature of the community of 23 Millas is that it is largely surrounded by the banana plantation, but its access is via the railway line (línea férrea); this public infrastructure also rises above the typical geography of the area, so we also analyzed the entry to the channel of this community from one of these points, in order to determine the elevation of the railway line, obtaining the following data: (…) The analyzed access is shown by the red line, from which the following data are obtained: (…) As can be observed, the difference in elevation between the highest point of the railway line and the section of land near this public infrastructure exceeds 1 meter.As an important input, some wide-angle photographs are provided from an altitude of approximately 50 meters: (…) Expanding somewhat on the subject of flooding, it must be emphasized that these sectors (23 Millas, Placeres, 24 Millas) are prone to flooding during the rainy season; it should be noted, moreover, that during the recent July flooding, this sector was even more severely affected due to damage to the retention structure (estructura de retención) located on the Río Barbilla. It is also important to take this point into account, as the breach occurred very close to the community of 23 Millas, thereby causing a disproportionate increase in the volume of water carried by the channel adjacent to the community, to the point where damage was recorded that had not been registered on previous occasions; a sketch map is attached to show the proximity to the described breach; it should be noted that the local government, immediately following these events, submitted the corresponding request to CNE and other institutions that collaborated in restoring the retention structure of the levee that protects the community of Matina: (…) As can be seen, the distance is approximately 1.7 kilometers — a very short distance — which, combined with the existing channel discussed throughout this report, caused the damage alleged by the residents.This can be seen in the following aerial photograph: (…) As part of the reconstruction work, photographs were taken to document the damage sustained by the levee that protects the community of Matina from the Río Barbilla and that affected the sector of 23 Millas; such photograph is provided herewith: (…) In light of the foregoing, it is concluded that the damage suffered by the sector of 23 Millas during the recent flooding is attributable primarily to the damage sustained by the structure of the levee known as Dique Placeres, caused by the flooding and the failure of water retention; furthermore, additional information must be obtained from the relevant departments regarding the infrastructure works carried out by the banana plantations in the study area. With no further matters for the moment, we respectfully close."
  4. 4Alfredo Wheathey Burton, in his capacity as President of the Municipal Council of Matina, submits a sworn report (written submission presented at 16:03 hours on September 24, 2021), in the same terms as Walter Céspedes Salazar, Mayor of Matina.
  5. 5By ruling of 16:27 hours on October 11, 2021, as additional evidence to aid in resolution (prueba para mejor resolver), the Reporting Magistrate (Magistrada Instructora) directed Walter Céspedes Salazar, in his capacity as Mayor of Matina, or whoever holds that office, to clarify to this Chamber who authorized the construction of the levee referred to by the petitioner and located in that canton (cantón), since the study attached indicates that the Municipal Road Management Technical Unit has no record of levees or constructions of this type, given that its primary function is the maintenance and upkeep of roads on the cantonal road network. This is further considered in light of what the petitioner has been claiming since amparo petition No. 10-002951-0007-CO — whose judgment (sentencia) 2010-007815, of 08:54 hours on April 30, 2010, is indicated to have not been complied with by that municipality — namely, information about the permits granted to the company Limonfrut C to carry out modifications to a levee located in the community where she resides.
  6. 6According to a certification dated December 14, 2021, the Mayor of Matina did not submit the report requested in the additional evidence ruling issued at 16:27 hours on October 11, 2021.
  7. 7By ruling of 14:57 hours on December 15, 2021, as additional evidence to aid in resolution, the Reporting Magistrate ordered the matter to be referred to the Juzgado Contravencional de Matina for personal service of the ruling of 16:27 hours of October 11, 2021 upon the Mayor of Matina.
  8. 8Walter Céspedes Salazar, in his capacity as Mayor of Matina, submits a sworn report (written submission presented at 15:57 hours on December 16, 2021), stating that, in compliance with the order issued by the ruling of 16:27 hours of October 11, 2021, he attaches the corresponding report prepared by Architect Carlos Fuentes Espinoza of the Construction Unit of the Municipality of Matina, official memorandum CMFE-2021-001, dated December 3, 2021, which certifies that no permit application for the construction of a levee or earthworks (movimientos de tierra) has ever been submitted to that municipality by the company Limonfrut C or any other natural or legal person, along the banks of the channel in the community of 23 Millas.
  9. 9The legal requirements governing these proceedings have been duly observed.

The opinion is authored by Magistrate Pacheco Salazar; and,

Considering:

I.Subject of the remedy. The petitioner alleges that the banana farm (finca bananera) Limonfrut C has, for a long time, been building and expanding a levee (dique) along the boundary with 23 Millas, in full view of and with the acquiescence of the Municipalidad de Matina. Although this work seeks to protect the plantation, it also exposes the population to imminent danger, since the community becomes enclosed by earthen walls.

II.Proven facts. The following facts are deemed duly established as relevant to the resolution of this matter, either because they have been substantiated in the record or because the respondents failed to address them as directed in the initial procedural order:

  • 1)On October 10, 2008, the community of 23 Millas de Matina submitted a written complaint to the Municipalidad expressing concern about the construction of a levee along the boundary with 23 Millas by the banana farm Limonfrut C, as the residents believed it entailed more risks than benefits. They also requested information as to whether permits had been granted for that construction (document submitted by the petitioner).
  • 2)On October 19, 2009, a group of residents of 23 Millas de Matina again submitted a document to the Municipalidad de Matina reiterating their concerns about the levee (document submitted by the petitioner).
  • 3)On February 26, 2010, the petitioner herein filed the writ of amparo (recurso de amparo) docketed under expediente 10-002951-0007-CO, on the grounds that a petition filed on June 9, 2008 and reiterated on October 19, 2009 — in which several residents of 23 Millas had asked the Concejo de Matina (Municipal Council of Matina) to be provided with information about the permits granted to the company Limonfrut C to carry out modifications to a levee located in their community — had gone unanswered. By judgment No. 2010-007815, issued at 08:44 hours on April 30, 2010, the writ of amparo was granted and the Mayor (Alcalde) and the President of the Concejo, both of the Municipalidad de Matina, were ordered to respond to both petitions within fifteen days (document submitted by the petitioner).
  • 4)The banana farm Limonfrut C has, for a long time, been building and expanding a levee along the boundary with 23 Millas, in full view of and with the acquiescence of the Municipalidad de Matina, notwithstanding that it exposes the population to imminent danger, since the community becomes enclosed by earthen walls (uncontested fact).
  • 5)No permit application for the construction of a levee or earthworks (movimientos de tierra) has ever been submitted to the Municipalidad de Matina by the company Limonfrut C or any other natural or legal person, along the banks of the canal in the community of 23 Millas (report of the respondent Mayor).
  • 6)On July 22, 2021, the community of 23 Millas de Matina suffered a severe flood, as a result of which it was cut off from the outside world and the local residents suffered irreparable economic losses (uncontested fact).
  • 7)The damage suffered by the 23 Millas sector during the July flood is primarily attributable to the damage sustained by the structure of the levee known as Dique Placeres, caused by flooding and the failure to retain water (document submitted by the respondent Mayor).
  • 8)Impacts not previously recorded on prior occasions occurred, and as a result the local government, immediately following these events, submitted the corresponding request to CNE and other institutions that collaborated to restore the retaining structure of the levee that protects the community of Matina (document submitted by the respondent Mayor).

III.On the right to a healthy and ecologically balanced environment. Derived from Articles 21 and 50 of the Political Constitution (Constitución Política), this Chamber has recognized the State's duty to protect the right to enjoy a healthy and ecologically balanced environment. It is from these provisions, together with international law and sub-constitutional environmental legislation, that the State's responsibility to exercise a protective and governing role in this area arises. The protection of this right is directly related to health and well-being; accordingly, the Costa Rican State is under an obligation to prevent the commission of acts that harm the environment. In this regard, in judgment No. 2013-008277, issued at 09:10 hours on June 21, 2012, this Chamber stated the following:

"the State is obligated to take all measures necessary within the scope permitted by law, in order to prevent irreversible damage to the environment from occurring, and must assume responsibility for achieving the social conditions conducive to enabling every person to enjoy health, understood as a state of physical, psychological, and social well-being." For the foregoing reasons, it falls to this Court to act as overseer of compliance with the obligations arising from Articles 21 and 50 of the Political Constitution, as it is the body that safeguards fundamental rights (judgment No. 2016-004961, issued at 09:05 hours on April 15, 2016).

IV.On the objective obligation of the State to protect human life. It has long been the case that the right to life, frequently analyzed in conjunction with the right to physical integrity, has been understood as a right with negative content — that is, its purpose was limited to a claim against the State to refrain from taking actions aimed at eliminating the physical existence of persons, such as torture or capital punishment, or to punish, through the criminal justice system, those persons — both public officials and private individuals — who threatened the life and physical integrity of others. However, the current trend is to impose upon the State various positive obligations, meaning that, beyond merely refraining from disturbing the physical existence of persons, the State must act to protect them against the many dangers that threaten their lives, whether those dangers arise from the actions of the State itself, from other persons, or even from nature itself.

This is why, for example, environmental matters have become — at least in our country — a constitutional issue, given that the right to a healthy and ecologically balanced environment was elevated to the rank of a fundamental right. It must be clarified, however, that the objective existence of an obligation on the part of the State to protect the right to life does not necessarily entail a subjective right on the part of individuals to demand, through judicial bodies, that a specific measure be taken; but it does entail a right to demand that appropriate measures be taken to protect that right in response to clearly negligent conduct on the part of public authorities. Thus, the State acquires the obligation to regulate those areas of social life from which dangers to the physical existence of the inhabitants of its territory may arise, whether through legislation, regulations, agreements, or other measures relating to administrative organization and procedures, and individuals have the subjective right to have the State proceed in this manner diligently.

Consequently, the possibility of judicially demanding, through the writ of amparo, a specific type of positive action by the State in fulfillment of its duty to protect the life and physical integrity of its inhabitants, is limited to cases where an imminent danger to those rights is clearly verified. It follows that the intervention of the constitutional jurisdiction is only viable in the face of a proven failure by the State, acting through its competent bodies, to attend to the demands that the inhabitants of the country make in the exercise of their rights (judgment No. 2006-018065, issued at 09:05 hours on December 15, 2006, reiterated, among others, in judgment 2020-003463, issued at 09:30 hours on February 21, 2020).

V.On the duty of municipalities to look after the inhabitants of the canton. Pursuant to Article 60 of the Ley Orgánica del Ambiente and judgment 2010-007858, issued at 09:37 hours on April 30, 2010, it is part of municipal duties to ensure the living conditions of the inhabitants of the canton, in the following terms:

"This Chamber has repeatedly noted that, as established by Article 169 of the Political Constitution and the Código Municipal, it falls to municipalities to administer local services and interests, with the aim of promoting the comprehensive development of the cantons in harmony with national development. Accordingly, the Municipality must establish a comprehensive urban planning policy in accordance with the relevant law, one that pursues the efficient and harmonious development of urban centers and that guarantees — at a minimum — efficient electrification and communications services; sound systems for the supply of drinking water and the disposal of wastewater through adequate aqueduct and sewage systems; modern systems of urban lighting and beautification; efficient services for the construction, repair, and cleaning of streets and other public roads; and, in general, concrete and practical plans to make the life of the population comfortable and safe."

VI.On the specific case. The petitioner claims that the respondent authorities have been deficient in addressing the problems that the community has experienced with the levee that the banana farm Limonfrut C has been building and expanding for a long time along the boundary with the community of 23 Millas, in full view of and with the acquiescence of the Municipalidad de Matina. For this reason, the community has been submitting petitions since October 10, 2008, as, while the work seeks to protect the plantation, it also exposes the population to imminent danger, since the community becomes enclosed by earthen walls. Indeed, on July 22, 2021, the community suffered a severe flood, as a result of which it was cut off from the outside world and the local residents suffered irreparable economic losses.

Of particular importance to the resolution of this matter is to reiterate that municipalities, by constitutional mandate, are charged with safeguarding local interests and must therefore oversee all works carried out within their jurisdiction. For this reason, even admitting that the banana company has built or repaired dikes (diques) without the corresponding municipal permits—it is reported that no permit application for the construction of a dike or for earthworks (movimientos de tierra) has ever been submitted to the Municipalidad de Matina by the company Limonfrut C or any other natural or legal person, along the canal banks in the community of 23 Millas—it is evident that, given the magnitude of the work, the municipal corporation should have become aware of its existence and, consequently, halted the construction activities. Nevertheless, the municipality did become aware of the construction or repair of dikes being carried out in the canton of Matina.

It is established that on October 10, 2008, the community of 23 Millas de Matina filed a written complaint with the Municipalidad expressing concern about the construction of a dike along the boundary with 23 Millas by the banana farm Limonfrut C, as they considered it to carry more risks than benefits. They also requested to be informed whether permits had been granted for that construction. Likewise, on October 19, 2009, a group of residents of 23 Millas de Matina again submitted another document to the Municipalidad reiterating the problem with the dike. Furthermore, on February 26, 2010, the petitioner herein filed a writ of amparo (recurso de amparo), processed under expediente 10-002951-0007-CO, for failure to respond to a request filed on June 9, 2008, and reiterated on October 19, 2009, in which several residents of 23 Millas asked the Concejo de Matina to provide them with information about the permits granted to the company Limonfrut C to carry out modifications to a dike located in the community where they reside.

By judgment No. 2010-007815, issued at 08:44 hours on April 30, 2010, the amparo was granted and the Mayor and the President of the Concejo, both of the Municipalidad de Matina, were ordered to respond to both requests within fifteen days. Thus, it is clear that, despite the authorities of that municipality having had full knowledge for more than a decade of the alleged situation, they have not taken the necessary steps to resolve it in a decisive manner. It is further reported that the flooding suffered by the 23 Millas area during the floods last July was primarily due to damage sustained by the structure of the dike known as Dique Placeres, caused by the floods and the failure to retain water. It is also reported that impacts occurred that had not been recorded on previous occasions, which is why the local government, immediately following these events, submitted the corresponding request to the Comisión Nacional de Emergencias (CNE) and other institutions that collaborated in rebuilding the retaining structure of the dike that protects the Matina community.

From the foregoing, it is concluded that the Municipalidad failed to act as required by constitutional mandate, and that a problem currently exists within its jurisdiction that must be given priority and a solution, in protection of the environment and the lives of its residents. Therefore, regardless of who was responsible for carrying out the work and the potential liabilities that may be established through ordinary court proceedings against the builders of the dike, the fact remains that the problem must be resolved. In light of what has been set forth in the preceding considerandos, it is clear that the municipal authorities are obligated to ensure the well-being of the inhabitants of their canton, in accordance with Article 169 of the Constitución Política, which entrusts these bodies with the administration of local services and interests of the canton. Likewise, the Sala has clearly indicated that this obligation takes on special relevance when the right to physical integrity is at stake, and that mere bureaucratic or budgetary arguments cannot be raised to delay the proper realization of fundamental rights. This Constitutional Tribunal has so ruled in considering the following:

"VI.- It must be borne in mind that the principle of legality has shed its formalism, which represented a considerable obstacle to the activity of state bodies and the effective realization of the fundamental rights established in the Constitución Política—specifically, the right to the provision of public services by the State. Local Governments must shift their role from passive spectator to one of vital and decisive protagonist in the welfare objectives set out in the constitutional text, given that they are designated as the administrators of local interests and services. In light of this, they must direct their full attention to the needs of their community, without allowing the customary refrains of lack of resources and bureaucratic constraints to prevent those needs from being met" (judgment No. 2009-002247, issued at 12:17 hours on February 13, 2009).

Under these circumstances, it is inevitable to grant the writ, since a swift and effective response from the Municipalidad de Matina is conspicuously absent in the face of what constitutes a severe threat to the life and physical integrity of the petitioner and the residents, a matter for which it has constitutional and legal competence.

VII.Conclusion. On the merits of the foregoing, the Sala finds that the respondent Municipalidad has failed to take the necessary actions to prevent the flooding problem that exists in the community of 23 Millas de Matina, which puts at risk the health and physical integrity of the petitioner and its residents each time there is heavy rainfall. In view of the foregoing, this Tribunal considers that the omissions attributed to the respondent municipal government are contrary to the provisions of Articles 21 and 50 of the Constitución Política, and therefore the writ must be granted, as is hereby ordered, with the effects set forth in the operative part of this judgment.

VIII. NOTE BY MAGISTRATE SALAZAR ALVARADO

In environmental matters, it is the view of the undersigned that where the Public Administration has already intervened, the matter's adjudication belongs to the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). Nonetheless, I do enter into the merits when other rights of affected persons are at stake, as occurs in this case, in which flooding in the community of 23 Millas de Matina is alleged to result from the construction of a dike, thereby placing the health and physical integrity of the petitioner and the residents at risk each time there is heavy rainfall.

IX.Documentation submitted to the case file. The parties are hereby notified that, if they have submitted any paper documents, as well as objects or evidence contained on any additional electronic, computer-based, magnetic, optical, telematic, or technology-produced devices, these must be retrieved from the office within a maximum period of thirty business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Session No. 27-11 of August 22, 2011, Art. XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in Session No. 43-12 held on May 3, 2012, Art. LXXXI.

Por tanto:

The writ is granted. Walter Céspedes Salazar and Alfredo Wheathey Burton, respectively, in their capacity as Mayor and President of the Concejo, both of the Municipalidad de Matina, or whoever may hold those positions, are hereby ordered to issue the pertinent instructions and carry out all actions within the scope of their competencies so that, within three months counted from the notification of this judgment, the flooding problem allegedly caused by a dike along the boundary with the community of 23 Millas de Matina, as reported by the petitioner [Nombre01 001], is resolved. The foregoing is without prejudice to any provisional measures that may prove necessary to prevent damage that rains may cause to the protected party. The respondents are hereby warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on anyone who receives an order—which they must comply with or enforce—issued in an amparo proceeding and fails to comply with or enforce it, provided that the offense is not more seriously punishable under another provision.

The Municipalidad de Matina is ordered to pay costs, damages, and losses occasioned by the facts giving rise to this declaration, to be assessed in enforcement proceedings before the contentious-administrative courts. Magistrate Salazar Alvarado appends a note. Notify the parties.

*210182740007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del catorce de enero de dos mil veintidos .

Recurso de amparo interpuesto por [Nombre01 001], mayor, en unión libre, asistente de gerencia, cédula de identidad [CED01], vecina de Matina, a favor del Grupo de vecinos de 23 Millas de Matina de Limón, contra el Alcalde y el Presidente del Concejo, ambos de la Municipalidad de Matina.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 09:53 horas del 16 de setiembre de 2021, la recurrente interpone recurso de amparo contra el Alcalde y el Presidente del Concejo, ambos de la Municipalidad de Matina y expresa que el 22 de julio de 2021, su comunidad tuvo una fuerte inundación que quedaron incomunicados y, además, los vecinos del lugar sufrieron pérdidas económicas irreparables. Refiere que la finca bananera Limonfrut C, desde hace mucho tiempo, está construyendo y ampliando un dique en la colindancia con 23 Millas, ello, a vista y paciencia de la Municipalidad recurrida. Pese a que esa obra busca proteger la plantación, también expone a la población a un peligro inminente, dado que, su localidad queda encerrada por paredes de tierras, con lo que "en futuras inundaciones que la altura de las aguas sea aún más altas y con esto el peligro que corren los habitantes es aún mayor".Arguye que el 10 de octubre de 2008, la comunidad de 23 Millas de Matina, planteó ante la Municipalidad por escrito, su preocupación por el levantamiento del dique, por conllevar más riesgos que beneficios. Allí, también requirieron se les indicara si se habían otorgado permisos para esa construcción. El 19 de octubre de 2009, casi un año después, un grupo de vecinos volvió a entregar otro documento al ente municipal en los mismos términos, sin que a la fecha, hayan recibido respuesta alguna de ninguno. Asevera que el 26 de febrero de 2010, tuvo que incoar un recurso de amparo que se tramitó en el expediente 10-002951-0007-CO, en el que, la Sala declaró con lugar el recurso; empero, la orden contenida en la resolución de las 08:44 horas del 30 de abril de 2010, nunca fue atendida por la Municipalidad accionada. Solicita que se ordene al municipio recurrido que ordene la suspensión de las obras en el dique y proceda con la demolición de lo ya construido, a fin de salvaguardar la integridad de los habitantes de la comunidad de 23 Millas. Por lo expuesto, estima que con la actuación de las autoridades recurridas, fueron lesionados derechos fundamentales.
  2. 2Mediante resolución de las 14:32 horas del 16 de setiembre de 2021, la Presidencia de la Sala dio curso a este amparo y se le solicitó informe al Alcalde y al Presidente del Concejo, ambos de Matina, sobre los hechos alegados por la recurrente.
  3. 3Informa bajo juramento Walter Céspedes Salazar, en su condición de Alcalde de Matina (escrito presentado a las 16:03 horas del 24 de setiembre de 2021), que adjunta el oficio UTGVM-PRS-044-2021, del 24 de setiembre de 2021, mediante el cual los señores Lic. Bryan Navarro Hernández, Promotor Social de la Unidad Técnica de Gestión Vial Municipal de ese ayuntamiento y el Ing. José Manuel Lee Obando, Asistente de esa Unidad, rinden el informe correspondiente. Ese documento indica lo siguiente: “de conformidad con una situación que se presenta en la comunidad de 23 millas (En atención al recurso de amparo bajo expediente 21-018274-0007-CO, esto a solicitud de información por parte de MBA. Johnny Rodríguez (Gerente Municipal) y Licenciado Ricardo Sossa (asesor legal de la Municipalidad de Matina)), el día 23 de setiembre del presente año, nos apersonamos al sitio. Es importante hacer de su conocimiento la ubicación del sitio donde se presentaron los hechos que se reportan en el recurso de amparo, por lo que para una mejor indicación se adjunta croquis: (…) En el sitio se realiza un levantamiento con aeronave no tripulada (dron), a fin de obtener un recurso (fotogrametría), esto para poder generar el presente informe, dando un insumo importante, se realiza un levantamiento de aproximadamente 4,5 hectáreas, resultando la siguiente área: (…) Se observa en el sitio un canal que fluye hacia la comunidad de 23 millas, aparentemente es un canal existente donde efectivamente se ven indicios de trabajos de limpieza, sin embargo, se desconoce el estado anterior a esta visita.Se presume que por la cantidad de agua que pasa por el sitio se generó un aumento en el sedimento del canal debido a las inundaciones recientes. Sin embargo, esta consulta debe de ser generada ante la empresa bananera, debe de ser claro y enfático que nuestro departamento no tiene un registro de diques o construcciones de este tipo, por cuanto nuestra función principal es la atención y mantenimiento de caminos de la RVC (Red Vial Cantonal). De este punto se genera el siguiente perfil del canal para su respectivo análisis: (…) De la imagen anterior, se observa que el canal, tiene un ancho de fondo aproximadamente 4 metros, se observan apilamientos de tierra a ambos lados, para un ancho aproximado de 35 metros. Se debe recalcar que la sección que se analiza es la línea roja de la ilustración 3, con una distancia de la sección transversal del canal de 83,5 metros. Se analiza una sección transversal del canal, en un tramo cercano a las viviendas contiguas al canal en 23 millas (por ser el lugar denunciado en el recurso de amparo), mismo que atraviesa la finca bananera y que sirve de desagüe del sector sur de la Dirección01, frente a la comunidad de 23 Millas, por lo que se obtiene un nuevo perfil, que fue analizando para identificar si se mantiene la condición de la ilustración 3, obteniendo el siguiente dato: (…) En esta sección (Ilustración 4), se toma una línea (la que aparece en color rojo), que corresponde a 62,5 metros (sección transversal al canal), del mismo dato se desprende que el apilamiento de material contiguo a la finca bananera se encuentra aproximadamente 2 metros más bajo que la altura que tiene el poblado de 23 millas.Este último punto es muy importante ya que, si bien es cierto todo este sector de Matina, corresponde a una llanura de inundación, al tener una diferencia de aproximados 2 metros, convierte el área noreste de la Ilustración 4, en un sector más propenso a recibir agua en caso de inundación. Otra particularidad que tiene la comunidad de 23 millas es que se encuentra rodeada en gran medida por Bananera, pero su acceso es atravesando la línea férrea, esta infraestructura pública, también presenta una elevación sobre la geografía típica de esta zona, por lo que analizamos también el ingreso al canal de esta comunidad desde uno de estos puntos, para conocer de la altura de la línea del Tren, obteniéndose el siguiente dato: (…) En la línea roja se observa el acceso analizado, mismo del que se obtiene el siguiente dato: (…) Como se observa la altura entre el punto más alto de la línea del tren y la sección del terreno cercano a esta infraestructura pública, supera una diferencia de 1 metro.Como insumo importante se generan algunas fotografías con panorama amplio desde una altura aproximada a los 50 metros: (…) Ahondando un poco en el tema de las inundaciones, se debe ser enfático al indicar que estos sectores (23 Millas, Placeres, 24 Millas), son propensos en época de lluvia a presentar inundaciones, dicho sea de paso, en la pasada inundación de Julio, este sector se vio aun más afectado, debido a la afectación de la estructura de retención que se encuentra en el Río Barbilla. Siendo importante considerar también este punto, por cuanto se dio esta ruptura y la misma es muy cercana a la comunidad de 23 millas, generando con esto un aumento desmedido en el caudal que se transportaba por el canal contiguo a la comunidad, a tal punto que se dieron afectaciones no registradas en ocasiones anteriores, se adjunta un croquis para observar la cercanía con el rompimiento descrito, se debe indicar que el gobierno local, inmediatamente al suceso de estos hechos, genera la solicitud correspondiente ante CNE y otras instituciones que colaboraron para reconformar la estructura de retención del dique que protege a la comunidad de Matina: (…) Como se observa, la distancia es de aproximadamente 1,7 kilómetros, una distancia muy corta, sumado al canal que ya existe y del que se ha conversado a lo largo del presente informe, generaron los daños que alegan los vecinos.Esto se puede ver en la siguiente foto panorámica: (…) Como parte de los trabajos de reconstrucción se generaron fotos para poder vislumbrar las afectaciones que se generaron en el dique que protege tanto a la comunidad de Matina del Río Barbilla y que afecta el sector de 23 millas, se facilita dicha toma: (…) Estando, así las cosas, se concluye que la afectación que sufrió en la pasada inundación el sector de 23 millas, responde principalmente al daño sufrido en la estructura del dique conocido como Dique Placeres, causado por las inundaciones y la falla en la retención del agua, además se tiene que ampliar información por parte de los departamentos pertinentes de los trabajos de infraestructura que intervienen las fincas bananeras en el sector de estudio. Sin otro particular de momento se despiden”.
  4. 4Informa bajo juramento Alfredo Wheathey Burton, en su condición de Presidente del Concejo Municipal de Matina (escrito presentado a las 16:03 horas del 24 de setiembre de 2021), en iguales términos que Walter Céspedes Salazar, Alcalde de Matina.
  5. 5Mediante resolución de las 16:27 horas del 11 de octubre de 2021, como prueba para mejor resolver, la Magistrada Instructora previno a Walter Céspedes Salazar, en su condición de Alcalde de Matina o a quien ocupe ese cargo, que aclare a esta Sala quién autorizó la construcción del dique que refiere la recurrente y que se ubica en ese cantón, pues en el estudio que adjunta se indica que la Unidad Técnica de Gestión Vial Municipal no tiene un registro de diques o construcciones de este tipo, por cuanto su función principal es la atención y mantenimiento de caminos de la red vial cantonal. Lo anterior tomando en cuenta, además, que lo reclamado por la recurrente desde el recurso de amparo No. 10-002951-0007-CO -cuya sentencia 2010-007815, de las 08:54 horas del 30 de abril de 2010, se señala no cumplió ese ayuntamiento- es información sobre los permisos otorgados a la empresa Limonfrut C para realizar modificaciones a un dique ubicado en la comunidad donde reside.
  6. 6Según constancia del 14 de diciembre de 2021, el Alcalde de Matina no rindió el informe que se le solicitó en la resolución de prueba para mejor resolver dictada a las 16:27 horas de 11 de octubre de 2021.
  7. 7Mediante resolución de las 14:57 horas del 15 de diciembre de 2021, como prueba para mejor resolver, la Magistrada Instructora dispuso comisionar al Juzgado Contravencional de Matina, a fin de que se le notificara en forma personal al Alcalde de Matina la resolución de las 16:27 horas de 11 de octubre de 2021.
  8. 8Informa bajo juramento Walter Céspedes Salazar, en su condición de Alcalde de Matina (escrito presentado a las 15:57 horas del 16 de diciembre de 2021), que, en cumplimiento de lo ordenado por resolución de las 16:27 horas de 11 de octubre de 2021, adjunto el informe correspondiente realizado por el Arquitecto Carlos Fuentes Espinoza de la Unidad de Construcciones de la Municipalidad de Matina, oficio CMFE-2021-001, del 03 de diciembre de 2021, en el que se hace constar que nunca se ha presentado ante ese ayuntamiento solicitud de permiso para la construcción de un dique o movimientos de tierra por parte de la sociedad Limonfrut C o cualquier otra persona física/jurídica, a las márgenes del canal en la comunidad de 23 Millas.
  9. 9En los procedimientos seguidos se han observado las prescripciones legales.

Redacta la Magistrada Pacheco Salazar; y,

Considerando:

I.Objeto del recurso. La recurrente alega que la finca bananera Limonfrut C, desde hace mucho tiempo, está construyendo y ampliando un dique en la colindancia con 23 Millas, ello, a vista y paciencia de la Municipalidad de Matina. Pese a que esa obra busca proteger la plantación, también expone a la población a un peligro inminente, dado que, su localidad queda encerrada por paredes de tierras.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque los recurridos hayan omitido referirse a ellos según lo prevenido en el auto inicial:

  • 1)El 10 de octubre de 2008, la comunidad de 23 Millas de Matina, planteó ante la Municipalidad por escrito, su preocupación por el levantamiento de un dique en la colindancia con 23 Millas, por parte de la finca bananera Limonfrut C, pues consideran que conlleva más riesgos que beneficios. También requirieron se les indicara si se habían otorgado permisos para esa construcción (documento aportado por la recurrente).
  • 2)El 19 de octubre de 2009, un grupo de vecinos de 23 Millas de Matina volvió a entregar otro documento a la Municipalidad de Matina reiterando la problemática con el dique (documento aportado por la recurrente).
  • 3)El 26 de febrero de 2010, la aquí recurrente interpuso el recurso de amparo que se tramitó en el expediente 10-002951-0007-CO, por falta de respuesta de una gestión presentada el 09 de junio de 2008 y reiterada el 19 de octubre de 2009, donde varios vecinos de 23 Millas solicitaron al Concejo de Matina que se les brindara información sobre los permisos otorgados a la empresa Limonfrut C para realizar modificaciones a un dique ubicado en la comunidad en que residen. Mediante sentencia No. 2010-007815, de las 08:44 horas del 30 de abril de 2010, se declaró con lugar el recurso el amparo y se ordenó al Alcalde y al Presidente del Concejo, ambos de la Municipalidad de Matina, contestar ambas gestiones en el plazo de quince días (documento aportado por la recurrente).
  • 4)La finca bananera Limonfrut C, desde hace mucho tiempo, está construyendo y ampliando un dique en la colindancia con 23 Millas, a vista y paciencia de la Municipalidad de Matina, a pesar de que expone a la población a un peligro inminente, dado que la localidad queda encerrada por paredes de tierras (hecho no controvertido).
  • 5)Ante la Municipalidad de Matina nunca se ha presentado solicitud de permiso para la construcción de un dique o movimientos de tierra por parte de la sociedad Limonfrut C o cualquier otra persona física/jurídica, a las márgenes del canal en la comunidad de 23 Millas (informe del alcalde recurrido).
  • 6)El 22 de julio de 2021, la comunidad de 23 Millas de Matina sufrió una fuerte inundación, por lo que quedó incomunicada y, además, los vecinos del lugar sufrieron pérdidas económicas irreparables (hecho no controvertido).
  • 7)La afectación que sufrió en la pasada inundación de julio el sector de 23 Millas, responde principalmente al daño sufrido en la estructura del dique conocido como Dique Placeres, causado por las inundaciones y la falla en la retención del agua (documento aportado por el alcalde recurrido).
  • 8)Se dieron afectaciones no registradas en ocasiones anteriores, por lo que el gobierno local, inmediatamente al suceso de estos hechos, generó la solicitud correspondiente ante la Comisión Nacional de Emergencias y otras instituciones que colaboraron para reconformar la estructura de retención del dique que protege a la comunidad de Matina (documento aportado por el alcalde recurrido).

III.Sobre el derecho a un ambiente sano y ecológicamente equilibrado . Derivado de los artículos 21 y 50 de la Constitución Política, esta Sala ha reconocido el deber del Estado de proteger el derecho a disfrutar de una ambiente sano y ecológicamente equilibrado. Es a partir de este articulado, de la normativa en derecho internacional y de la normativa infraconstitucional en materia ambiental, que nace la responsabilidad del Estado de ejercer una función tutelar y rectora en la materia. La protección de este derecho, tiene una relación directa con el bienestar en materia de salud, por lo que el Estado costarricense se encuentra en la obligación de prevenir la realización de actos que lesionen el medio ambiente. En este sentido, en la sentencia No. 2013-008277, de las 09:10 horas del 21 de junio de 2012, esta Sala señaló lo siguiente:

“se obliga al Estado a disponer todo lo que sea necesario dentro del ámbito permitido por la ley, a efecto de impedir que se produzcan daños irreversible en el medio ambiente, debiendo asumir la responsabilidad de lograr las condiciones sociales propicias a fin de que cada persona pueda disfrutar de su salud, entendido tal derecho, como una situación de bienestar físico, psiquico y social”.

Por lo señalado anteriormente, corresponde a este Tribunal erigir funciones como contralor del cumplimiento de las obligaciones que se derivan de lo dispuesto en los artículos 21 y 50 de la Constitución Política, pues es el órgano garante de los derechos fundamentales (sentencia No. 2016-004961, de las 09:05 horas del 15 de abril de 2016).

IV.Sobre la obligación objetiva del Estado de tutelar la vida humana . Ha sido usual que el derecho a la vida, frecuentemente analizado conjuntamente con el derecho a la integridad física, haya sido entendido como un derecho de contenido negativo, es decir, su objeto se limitaba a la pretensión contra el Estado que se abstuviera de realizar acciones dirigidas a eliminar la existencia física de las personas, por ejemplo la tortura o la pena de muerte, o bien que castigara a las personas, públicas y privadas, que atentaran contra la vida e integridad de los otros, a través del sistema penal; sin embargo, la tendencia actual es imponer al Estado diversas conductas positivas, en el sentido que más allá de perturbar la existencia física de las personas, debe actuar en tutela de su protección, ante los múltiples peligros que la acechan, bien sea que ellos provengan de acciones del Estado mismo o de otras personas, e inclusive, de la misma naturaleza.

De ahí que, por ejemplo, los temas ambientales han pasado a ser, al menos en nuestro país, un asunto de índole constitucional, puesto que el derecho a un ambiente sano y ecológicamente equilibrado fue elevado a rango de derecho fundamental. Ahora bien, es menester aclarar que la existencia objetiva de una obligación del Estado en lo referente a la protección del derecho a la vida no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se tomen las medidas idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas. Se trata así que el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio, ya sea a través de la ley, de reglamentos, de acuerdos o de otras medidas relacionadas con la organización y los procedimientos administrativos, y del derecho subjetivo de las personas a que así se proceda, en forma diligente.

En consecuencia, la posibilidad de exigir, judicialmente, a través del recurso de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida e integridad física de sus habitantes, es restringida a la clara verificación de un peligro inminente contra esos derechos de las personas. De lo que se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes, en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país (sentencia No. 2006-018065, de las 09:05 horas del 15 de diciembre de 2006, reiterada, entre otras, en la sentencia 2020-003463, de las 09:30 horas del 21 de febrero de 2020).

V.Sobre el deber de las municipalidades de velar por los habitantes del cantón. De conformidad con el artículo 60 de la Ley Orgánica del Ambiente y la sentencia 2010-007858, de las 09:37 horas del 30 de abril de 2010, forma parte de los deberes municipales velar por las condiciones de vida de los habitantes del cantón, en los términos que siguen:

“Esta Sala en reiteradas ocasiones ha señalado que conforme lo establece el artículo 169 de la Constitución Política y el Código Municipal, corresponde a las Municipalidades la administración de los servicios e intereses locales, con el fin de promover el desarrollo integral de los cantones en armonía con el desarrollo nacional. En consecuencia, la Municipalidad debe establecer una política integral de planeamiento urbano de acuerdo con la ley respectiva, que persiga el desarrollo eficiente y armónico de los centros urbanos y que garantice -al menos- eficientes servicios de electrificación y de comunicación; buenos sistemas de provisión de agua potable y evacuación de aguas servidas, mediante adecuados sistemas de acueductos y alcantarillado, modernos sistemas de iluminación y ornato de las ciudades; eficientes servicios de construcción, reparación y limpieza de calles y otras vías públicas; y en general planes concretos y prácticos para hacer confortable y segura la vida de la población”.

VI.Sobre el caso concreto. La recurrente reclama que las autoridades recurridas han sido deficientes en atender la problemática que sufren con el dique que en la colindancia con la comunidad de 23 Millas está construyendo y ampliando desde hace mucho tiempo la finca bananera Limonfrut C, a vista y paciencia de la Municipalidad de Matina. Situación por la cual han presentado gestiones desde el 10 de octubre de 2008, pues si bien la obra busca proteger la plantación, también expone a la población a un peligro inminente, dado que, su localidad queda encerrada por paredes de tierras. Incluso, el 22 de julio de 2021, la comunidad sufrió una fuerte inundación, por lo que quedó incomunicada y, además, los vecinos del lugar sufrieron pérdidas económicas irreparables.

De particular importancia para la resolución de este asunto es reiterar que las municipalidades, por mandato constitucional están encargadas de velar por los intereses locales y en consecuencia deben fiscalizar todas aquellas obras que se realicen dentro de su jurisdicción, razón por la cual, aun admitiendo que la empresa bananera ha construido o reparado diques sin los respectivos permisos municipales (se informa que ante la Municipalidad de Matina nunca se ha presentado solicitud de permiso para la construcción de un dique o movimientos de tierra por parte de la sociedad Limonfrut C o cualquier otra persona física/jurídica, a las márgenes del canal en la comunidad de 23 Millas) es evidente que por la magnitud de la obra, la corporación municipal debió percatarse de su existencia y, en consecuencia, detener las labores de construcción. No obstante, la municipalidad tuvo conocimiento de las construcciones o reparaciones de diques que se estaban llevando a cabo en el cantón de Matina.

Se acredita que el 10 de octubre de 2008, la comunidad de 23 Millas de Matina, planteó ante la Municipalidad por escrito, su preocupación por el levantamiento de un dique en la colindancia con 23 Millas, por parte de la finca bananera Limonfrut C, pues consideran que conlleva más riesgos que beneficios. También requirieron se les indicara si se habían otorgado permisos para esa construcción. Igualmente, el 19 de octubre de 2009, un grupo de vecinos de 23 Millas de Matina volvió a entregar otro documento a la Municipalidad reiterando la problemática con el dique. Además, el 26 de febrero de 2010, la aquí recurrente interpuso el recurso de amparo que se tramitó en el expediente 10-002951-0007-CO, por falta de respuesta de una gestión presentada el 09 de junio de 2008 y reiterada el 19 de octubre de 2009, donde varios vecinos de 23 Millas solicitaron al Concejo de Matina que se les brindara información sobre los permisos otorgados a la empresa Limonfrut C para realizar modificaciones a un dique ubicado en la comunidad en que residen.

Mediante sentencia No. 2010-007815, de las 08:44 horas del 30 de abril de 2010, se declaró con lugar el recurso el amparo y se ordenó al Alcalde y al Presidente del Concejo, ambos de la Municipalidad de Matina, contestar ambas gestiones en el plazo de quince días. De este modo, resulta claro que, pese a que las autoridades de tal municipio tienen pleno conocimiento, desde hace más de un decenio, de la situación alegada, no han realizado las gestiones necesarias para solventarla de manera contundente. Incluso se informa que la afectación que sufrió en la pasada inundación de julio el sector de 23 Millas, responde principalmente al daño sufrido en la estructura del dique conocido como Dique Placeres, causado por las inundaciones y la falla en la retención del agua. Además, que se dieron afectaciones no registradas en ocasiones anteriores, por lo que el gobierno local, inmediatamente al suceso de estos hechos, generó la solicitud correspondiente ante la Comisión Nacional de Emergencias y otras instituciones que colaboraron para reconformar la estructura de retención del dique que protege a la comunidad de Matina.

De lo expuesto, se concluye que la Municipalidad omitió actuar según corresponde por mandato constitucional y en la actualidad existe un problema dentro de su jurisdicción al cual debe darse prioridad y solución, en tutela del medio ambiente y la vida de sus munícipes. Así que independientemente de quien fue el encargado de ejecutar la obra y las eventuales responsabilidades que puedan sentarse en la vía ordinaria con respecto a los constructores del dique, lo cierto es que el problema debe solucionarse. A la luz de lo expuesto en los anteriores considerandos, es claro que las autoridades municipales se encuentran obligadas a velar por el bienestar de los habitantes de su cantón, conforme lo dispuesto por el artículo 169 de la Constitución Política, que encomienda a estos entes la administración de los servicios locales e intereses del cantón. Asimismo, la Sala ha sido clara en señalar que dicha obligación cobra especial relevancia cuando se encuentra de por medio el derecho a la integridad física, no siendo oponibles meros argumentos burocráticos o presupuestarios para prolongar la debida realización de los derechos fundamentales. Así, lo ha resuelto este Tribunal Constitucional al considerar lo siguiente:

“VI.- Debe tenerse en cuenta que el principio de legalidad ha dejado atrás su formalidad, lo que representaba un obstáculo considerable para la actividad de los órganos estatales y la efectiva realización de los derechos fundamentales que establece la Constitución Política, propiamente, el derecho a la prestación de servicios públicos por parte del Estado. Los Gobiernos Locales deben de cambiar su papel pasivo de espectador ante uno de protagonista vital y definitivo en los propósitos de bienestar trazados en el texto Constitucional, al señalárseles que son los administradores de los intereses y servicios locales. Ante ello deben volcar toda su atención a las necesidades de su comunidad, sin que los ya acostumbrados estribillos de falta de recursos y anclajes burocráticos impidan satisfacer aquellas necesidades” (sentencia No. 2009-002247, de las 12:17 horas de 13 de febrero de 2009).

En estas circunstancias es inevitable estimar el recurso, toda vez que se echa de menos una acción célere y eficaz de parte de la Municipalidad de Matina frente a lo que constituye una severa amenaza para la vida e integridad física de la recurrente y los vecinos, para lo cual tiene competencia constitucional y legal.

VII.Conclusión. En mérito de lo expuesto, estima la Sala que la Municipalidad recurrida ha omitido efectuar las acciones necesarias para prevenir el problema de inundaciones existente en la comunidad de 23 Millas de Matina, lo cual pone en riesgo la salud y la integridad física de la recurrente y sus pobladores cada vez que existen precipitaciones fuertes. En atención a lo anterior, este Tribunal considera que las omisiones atribuidas al ayuntamiento recurrido atentan contra lo dispuesto en los artículos 21 y 50 de la Constitución Política, por lo que el recurso debe ser declarado con lugar, como en efecto se dispone y con los efectos que se indican en la parte dispositiva.

VIII. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas, tal y como sucede en este caso, en el que se acusan inundaciones en la comunidad de 23 Millas de Matina, debido a la construcción de un dique, lo cual pone en riesgo la salud y la integridad física de la recurrente y sus pobladores cada vez que existen precipitaciones fuertes.

IX.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial ", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Walter Céspedes Salazar y a Alfredo Wheathey Burton, respectivamente, en su condición de Alcalde y de Presidente del Concejo, ambos de la Municipalidad de Matina o a quienes ocupen esos cargos, que giren las órdenes pertinentes y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias, para que, dentro del plazo de tres meses, contado a partir de la notificación de esta sentencia, se solucione el problema de inundaciones que se indica causa un dique en la colindancia con la comunidad de 23 Millas de Matina, según lo denunciado por la recurrente [Nombre01 001]. Lo anterior, sin perjuicio de los trabajos provisionales que eventualmente resulten necesarios efectuar para evitar los daños que puedan causarle las lluvias a la tutelada. Se advierte a los recurridos que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de Matina al pago de las costas, daños y perjuicios ocasionados por los hechos que han dado lugar a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Salazar Alvarado pone nota. Notifíquese.
