Document Review SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours and twenty minutes on the fourteenth of January, two thousand and twenty-two.

Writ of amparo (recurso de amparo) filed under case number 21-023487-0007-CO, brought by ALEJANDRA CHAVES CHAVES, national identification number CED01, against the Municipalidad de Alajuela.

Background:

  1. 1Filed into the digital case record at 21:58 hours on November 17, 2021, the petitioning party brings a writ of amparo. She states that she is the owner of a property located at Dirección01, in Desamparados de Alajuela, specifically in the Urbanización El Valle, which is registered with the Property Registry under parcel (finca) number 242586. She notes that, due to the large number of residential developments built in the area, the stream running near her home has increased considerably in flow, as it now carries not only stormwater (aguas pluviales) but also soapy water (aguas jabonosas) and sewage (aguas negras), which stagnate during the dry season, causing foul odors and the proliferation of mosquitoes such as those that transmit dengue fever. She adds that the problem described also affects the 42 homes located in that development. She explains that the volume of water flowing through the river has caused severe erosion; in fact, 2 trees standing alongside the watercourse (cauce) have fallen, carrying with them a significant portion of land at the end of the street and from a lot designated as a green area.She notes that the green-area parcel (fundo) is currently unusable because there is no safety barrier to prevent people from falling into the river. She asserts that the streambed of the creek has grown considerably in volume, given that the Municipalidad de Alajuela failed to address the drainage system (alcantarillado) for the waters and, to the contrary, issued construction permits, which has worsened the situation described. She alleges that there is a new project in the area called Hogares de Costa Rica, which owns a property bordering the Urbanización El Valle to the east and is being used as a water outlet. She states that the project sits at the top of the development and the lot, where a treatment plant (planta de tratamiento) and a water retention pond (laguna de contención) for the new homes to be built are planned, and that this pond will be located approximately 10 meters from the rear boundary of her property.She affirms that on November 24, 2020, she filed a complaint with the Municipalidad de Alajuela, through which she requested: "(…) that this second tree be cut down and that both be removed from the gully [cañó, sic], because if there is heavy rain it will fill up and our homes could flood, and second, please pipe that waterway, which appears to carry stormwater and soapy water, to prevent it from continuing to erode the land, in addition to the already-mentioned odors and pests (…)". She alleges that, in the face of the local government's inaction in resolving the situation described, new difficulties have since arisen. She reports that for some months now, every afternoon, the Condominio Aguas Claras discharges sewage or soapy water into the stream, generating strong odors that affect the residents of the Urbanización El Valle. She indicates that approximately 50 meters from the development there is a spring (naciente) that is being affected by the contamination from those improperly conveyed waters, and that this water source is under the responsibility of the Instituto Costarricense de Acueductos y Alcantarillados.She states that, as a result of the erosion at the site, her property has suffered significant harm, as it lies only 2 meters from the streambed, a situation that has negatively affected the value of the parcel and its insurability. She adds that there is a risk that her home's structure will sustain considerable damage, as tree roots extend beneath the dwelling and part of her house could be dragged away. She recounts that the Comisión Nacional de Prevención de Riegos y Atención de Emergencias (CNE) issued three recommendations to the aforementioned municipality; however, these have not been properly followed up on nor has the problem been resolved. She states that she cannot understand why the respondent local government has failed to account for the need for drainage infrastructure to channel the waters from new projects and thereby prevent damage to her property. She considers her fundamental rights to have been violated. She requests that the complaint filed on November 24, 2020, be addressed. She asks that the problem described be resolved.
  2. 2By resolution of the President of the Sala at 12:29 hours on November 18, 2021, the proceedings were admitted and the mayor, the head of the Cantonal Risk Prevention and Management Area, the coordinator of the Infrastructure Planning and Construction Process, and the coordinator of the Stormwater Drainage Activity, all of the Municipalidad de Alajuela, were required to report on the facts alleged by the petitioning party.
  3. 3In a written statement entered into the digital case file (expediente) at 16:34 hours on November 25, 2021, Sofía González Barquero, Roy Delgado Alpízar, Juan José Moya Argüello, and Lawrence Chacón Soto reported under oath, serving respectively as mayor, coordinator of the Municipal Infrastructure Planning and Construction Process, officer for Cantonal Risk Prevention and Management (Prevención y Gestión del Riesgo Cantonal), and coordinator of the Stormwater Drainage Activity (Actividad de Alcantarillado Pluvial), all of the Municipality of Alajuela. They stated that: "Through official communication (oficio) N° MA-A-6099-2021, Lic. Luís Alonso Villalobos Molina, Legal Advisor to the Mayor's Office (Alcaldía), noted that: 'In response to the petitioner's follow-up inquiry submitted to the Mayor's Office—as the Superior Body of the Municipal Administration—regarding her administrative proceeding (trámite) 25465-2020, specifically with respect to the portion of that proceeding related to her request to cut a tree that had fallen into a drainage canal (caño) adjacent to her home, which she argued could flood the house, the Mayor's Office, through official communication No MA-A-2591-2021 dated May 20, 2021, issued instructions to the coordinators of the Sanitary Drainage (Alcantarillado Sanitario), Public Investment Works, and Cantonal Risk Management (Gestión de Riesgo Cantonal) units, so that—building on the initial institutional response to the proceeding set out in official communication MA-PPCI-OGRC-0023-2021 dated January 6, 2021—immediate communication and coordination would be established among the units and their professionals, with the aim of definitively carrying out on-site intervention at the earliest possible time through whatever measures might be appropriate.Said official communication, containing the aforementioned instructions, was duly served on May 20, 2021, both on the heads of the relevant units and on the petitioner.'" They further stated that: "'In response to what was required by the Mayor's Office in official communication MA-A-2591-2021, through official communication MA-AAP-0435-2021 dated May 25, 2021, the Stormwater Drainage Activity reported that this unit had carried out works to remove the tree that was located inside the Canal and was causing obstruction of stormwater (aguas pluviales), all of which took place during the first week of December 2020. The foregoing notwithstanding, it was clarified that only the main trunk remained unextracted; however, due to the height at which it sits and its dimensions, weight, and position, it does not affect water flow, and the unit does not possess the machinery or equipment needed to extract it.The response contained in the cited official communication was forwarded by the Mayor's Office to the petitioner at her email address on May 31, 2021, through official communication N° MA-A-2732-2021, by which a copy was also sent to the Stormwater Drainage unit requesting that it continue monitoring the case. In an email received on that same May 31, in response to the official communication that had been generated, the petitioner indicated that, since the trunk remained in the ground it was still alive and that branches would grow, that the problem would continue, and that she was asking to be informed of a final solution to the problem. In response to that email from the petitioner, the undersigned forwarded that same day the petitioner's communication to the heads of the Stormwater Drainage and Risk Management units, indicating that, pursuant to superior instructions, he was requesting them to take note of everything noted by the taxpayer (contribuyente) in order to schedule a new site visit and evaluate further actions if warranted.'" They cite memorandum MA-ACC-4719-2021 of November 24, 2021, signed by the coordinator of the Construction Control Activity (Actividad de Control Constructivo).They state that: "'Through official communication N° MA-PPCI-PGRC-0752-2021 dated November 23, 2021, signed by Ing. Juan José Moya Argüello, Officer for Cantonal Risk Prevention and Management, Infrastructure Planning and Construction, it was stated in summary that the matter was duly attended to and made known to several units, which confirmed that the tree had fallen, creating a potential emergency at the site; however, there were also abandoned vehicles nearby, as demonstrated by the attached photograph, and a workshop encroaching on the protection zone (zona de protección) (…) A fact that was verified by the Environmental Management Sub-process (Subproceso de Gestión Ambiental), as recorded in official communication MA-SGV-741~2020, which states that during an inspection carried out at the site the tree was found to be located within the protection zone of the water body (cuerpo de agua), and that therefore issuing a technical opinion on the matter fell outside the competence of that unit, in accordance with the provisions of the Ley Forestal, for which reason it recommends referring the case to the SINAC-MINAE directorate in Alajuela for appropriate action.On November 11, 2020, official communication OA-1207 was received from SINAC-MINAE of Alajuela, indicating that a site visit was carried out where the tree species found is Poró, which is leaning toward the watercourse (cauce) of the Quebrada Targuá, located on the left bank (ribera izquierda) of the stream; they also noted that a large quantity of automotive waste was observed, which threatened to slide into the watercourse. In light of the foregoing, that agency, in its conclusions and recommendations, indicated that, since an automotive workshop was situated within the 10 m protection area of the Quebrada Targuá—an activity that negatively impacts the soil without allowing it to recover—it would proceed with the relevant actions under current legislation, and would also serve an administrative notice (prevención administrativa) on the property owner, requiring the immediate implementation of the corresponding corrective measures; in the event of non-compliance, a report would be filed with the Ministerio Público, adding that follow-up would be conducted to ensure proper compliance.On November 19, 2020, official communication MA-PSMCV-1045-2020 was received from the Municipal Security and Traffic Control Process (Proceso de Seguridad Municipal y Control Vial), indicating that a site visit was conducted during which the vehicle owners were spoken to and given a 48-hour period from November 6 to comply; after that, during a visit on November 19, it was confirmed that the abandoned vehicles had already been removed from the public roadway by their owners, thereby partially resolving the situation described with respect to vehicles located on the public road. On November 20, 2020, report CNE-UIAR-0986-2020 was received from the Risk Research and Analysis Unit (Unidad de Investigación y Análisis del Riesgo) of CNE, a report that originated from a request submitted by Ms. Alejandra Chaves; it states that at the time of the inspection the fallen tree was still present near the water body, apparently having fallen due to erosion of the banks of the watercourse; they also noted that erosion of the canal has directly endangered a structure that is apparently being used as a workshop, where garbage was also observed, and that this structure is located less than 10 m from the watercourse.Accordingly, the conclusions state that the tree in the watercourse represents a risk, as it could cause damming (represamiento) if not removed, and that the lack of bank protection and the large volume of water collected from the upper areas have increased the erosive force and the resulting damage; if the watercourse is not intervened and a protective structure is not built to prevent canal erosion, the slope will continue to be undermined, eventually putting the home and the workshop at risk. Finally, in its recommendations, CNE indicates that the municipality must remove the fallen tree in the short term to prevent damming of the watercourse, and must also assess the possibility of constructing a structure to protect the banks and thereby prevent erosion, such as the implementation of retention ponds (lagunas de retención) to reduce flood vulnerability—a measure that was in fact carried out by the Stormwater Drainage Activity, as will be indicated.'" They transcribe the content of official communication MA-AAP-0954-202 of November 23, 2021, signed by the coordinator of the Stormwater Drainage Activity and the director of the Municipal Infrastructure Planning and Construction Process.They consider that the municipal government has been diligent and has carried out the tasks within its competence. They note that it was confirmed that the "Condominio Azul" project meets the parameters established by the municipality. They state that all proceedings filed by the petitioner have been attended to. They assert that "there are no records at the municipal level of complaints regarding impacts to 42 homes in the area, and the protected party (amparada) has not demonstrated this either, merely asserting it without providing the evidence to support it."
  4. 4The required legal provisions have been observed in the proceedings conducted.

Drafted by Magistrate Rueda Leal; and,

Considering:

I. REGARDING THE EXCEPTION UNDER ARTICLE 41 OF THE POLITICAL CONSTITUTION

One of the aspects raised could constitute a violation of the right to prompt and effective administrative justice. In this regard, it must be clarified that, beginning with vote number 2008-02545 issued at 8:55 hours on February 22, 2008, this Court has referred to the administrative-contentious jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters in which it is disputed whether a public authority has complied with the deadlines set by the General Public Administration Act (Ley General de la Administración Pública) (articles 261 and 325) or by sector-specific laws governing special administrative procedures, in order to resolve by a final administrative act (acto final) an administrative proceeding—initiated ex officio or at the request of a party—or to hear applicable administrative appeals. This case falls precisely within one of those exceptions, as the sub examine concerns the filing of complaints regarding the location of trees that create a risk of flooding in the event of rain, as well as erosion affecting a property due to a drainage canal. In view of the foregoing, the Court will proceed to resolve the appeal.

II. SUBJECT MATTER OF THE APPEAL

The petitioner states that she owns a home in the residential development (urbanización) El Valle in Desamparados de Alajuela. She notes that, due to the large number of residential developments built in the area, the stream (arroyo) that runs near her home has increased considerably in flow, as it now carries not only stormwater but also greywater (aguas jabonosas) and sewage (aguas negras), which during the dry season stagnate and cause foul odors and mosquito proliferation. She explains that the volume of water flowing through the river has caused significant erosion, and that two trees standing beside the watercourse have even fallen. She states that on November 24, 2020, she filed a complaint with the Municipality of Alajuela, through which she requested: "(…) that the second tree be cut down and that both be removed from the canal (caño), because if there is heavy rain it could fill up and flood our homes, and secondly that the water channel, which appears to carry stormwater and greywater, be enclosed in a pipe to prevent further ground erosion, in addition to the aforementioned issues of odors and pests (…)." She alleges that, in the face of inaction by the local government to resolve the described situation, new difficulties have since arisen.

She recounts that in November 2020, CNE issued three recommendations addressed to the aforementioned municipality regarding the reported problem; however, these have not been properly followed up on nor has the problem been resolved.

III. PROVEN FACTS

The following facts are considered to have been duly established as relevant to the decision in this matter, either because they have been substantiated as such or because the respondent authority failed to address them, as provided in the initial order:

  • a)The petitioner owns a home located in the residential development El Valle in Desamparados de Alajuela. (Undisputed fact).
  • b)On November 17, 2020 — received on November 24, 2020 — the protected party (amparada) filed a petition with the Municipalidad de Alajuela, assigned filing number (trámite) 25465-2020, in which she stated:

"I am writing to you through this means to seek a solution to certain difficulties that have arisen beside my home. Allow me to briefly recount what has happened.

Our house had a setback of 10 linear meters from the drainage channel (caño) to the house, with the plot in between being a green area (zona verde) of the residential development (urbanización). Over the years, and due to the residential complexes built in recent years to the northeast of the property, the volume of water flowing through that channel (sic) has increased — water that, it should be noted, stagnates in summer and causes foul odors and pest outbreaks such as Dengue, which my nieces and nephews have already contracted. This problem not only affects me and my family, but (sic) all of us who live in this area.

In recent years, those volumes of water have caused the ground to become undermined and the channel (sic) to grow much larger, to the point that the lot now measures only 6 linear meters.

Furthermore, there have always been 2 quite large trees whose roots have grown very deep; one of them fell on November 2 of this year onto the channel bed (sic), taking with it a great deal of soil, three cars, and part of the street at its end. The other tree, whose roots are affecting my property, has already made a rumbling sound and is about to fall; if this happens, it will significantly impact my house because of the roots.

We need 2 things: first, that the second tree be cut down and that both be removed from the channel (sic), because if it rains heavily the channel could fill up and flood our homes; and second, that the waterway — which appears to carry stormwater and soapy water — be enclosed in pipes to prevent it from continuing to erode the ground, in addition to the aforementioned issues of odors and pests.

  • c)On November 19, 2020, CNE issued technical report CNE-UIAR-INF-0986-2020, "Flood Risk and Ground Instability Assessment Due to Tree Collapse into Watercourse," in which it stated:

"I. General Information At the request of the interested party, on November 12 a visual risk assessment was conducted in Desamparados de Alajuela, due to the erosion of a watercourse that caused the collapse of a tree (…)

V. Conclusions

A. Apparently, the erosion of the watercourse undermined (sic) the tree's roots, causing it to collapse.

B. Based on field observations and analysis of maps and aerial photographs, this watercourse is not natural and is a drainage system that collects water from homes in the upper part of the watershed (cuenca).

C. The lack of protection along the banks of the watercourse and the large volume of water collected from the upper part have increased the erosive force and the resulting damage.

D. The tree in the watercourse poses a risk, as it could cause a damming (represamiento).

E. Without intervening in the watercourse and constructing a protective structure to prevent erosion, the channel will continue to undermine the hillside and will eventually endanger the house and the workshop.

VI. Recommendations

Nombre01. The Municipality must, in the short term, remove the fallen tree to prevent damming.

B. It must also evaluate the possibility of constructing a structure to protect the banks in order to prevent continued erosion, and implement retention ponds (lagunas de retención) to reduce vulnerability to flooding.

C. Any work carried out must be done under the supervision of a qualified professional and supported by the corresponding studies (…)" (emphasis added).

Said report was served on the respondent municipal corporation on November 20, 2020. (See documentary evidence and sworn report submitted by the respondent authorities.)

  • d)On January 6, 2021, officials from the Planning and Infrastructure Construction Process (Proceso de Planeamiento y Construcción de Infraestructura) of the Municipalidad de Alajuela sent official memorandum MA-PPCI-PGRC-0023-2021 to the coordinator of the Stormwater Drainage Activity (Actividad de Alcantarillado Pluvial), in which they stated:

"(…) filing #25465-2020 is hereby forwarded for your attention, together with copies of official memoranda MA-PSMCV-1045-2020, MA-SGA-741-2020, CNE-UIAR-INF-0986-2020, and OA-1207, which correspond to a situation already referred to your office since November 3, 2020, through official memorandum MA-PPCI-PGRC-0704-2020.

As a result, a new site inspection was conducted and the existing problem at the site was found to persist; therefore, you are requested to use your good offices in addressing the situation and to thereby provide a response to those affected (sic), given that the site currently presents the need for PRIORITY and URGENT intervention. It should be emphasized that we are prepared to collaborate in managing the situation, whether through technical supervision of the works or, failing that, through the corresponding procurement process, provided that (sic) the necessary resources are available." (See documentary evidence.)

  • e)On May 20, 2021, a Municipalidad de Alajuela official sent memorandum MA-A-2591-2021 to Lawrence Chacón Soto, Kasey Palma Chavarría, and Juan José Moya Argüello — the Stormwater Drainage Activity coordinator, the Public Investment Works Sub-Process (Subproceso de Obras de Inversión Pública) coordinator, and a Cantonal Risk Prevention and Management officer, respectively. In that memorandum, in relation to filing no. 25465-2020 and the terms of official memorandum MA-PPCI-PGRC-00232021, the following was requested: "Establish immediate communication and coordination of the case among the relevant offices and professionals, so that — through whatever steps prove pertinent — the appropriate intervention at the site may be carried out definitively and as soon as possible." (See documentary evidence.)
  • f)On May 25, 2021, the Stormwater Drainage coordinator of the respondent local government issued official memorandum MA-AAP-0435-2021, addressed to the mayor of Alajuela and concerning the complaint filed by the protected party, in which it was stated that:

"this office carried out tree-removal work on the tree that was located inside the channel and was obstructing the flow of stormwater, all of which was completed during the first week of December 2020.

It should be clarified that only the main trunk was left without being extracted; however, it does not affect the flow of water given the height at which it lies, and due to its dimensions, weight, and position, we do not have the machinery or equipment required for its removal." (See documentary evidence.)

  • g)On May 28, 2021, an advisor at the Municipalidad de Alajuela sent official memorandum MA-A-2732-2021 to the protected party, indicating that, in response to complaint no. 25465-2020, memorandum MA-AAP-0435-2021 is enclosed, "which contains a report on the work carried out and water management matters. Additionally, by copy of this memorandum, the said office is requested to maintain follow-up on the case of interest." (See documentary evidence.)
  • h)On May 31, 2021, the respondent municipal corporation notified the protected party, via email, of official memorandum MA-A-2732-2021 concerning the response to complaint no. 25465-2020. She was also informed that "the respective office is being requested to maintain follow-up on the situation." (See documentary evidence.)
  • i)On May 31, 2021, the protected party sent an email to an official of the respondent local government, in which she stated:

"(…) Indeed, they did carry out part of the extraction, but since the trunk remains in the ground it is still alive and is once again sprouting branches, and since it lies in a horizontal position, branches will also grow downward.

Furthermore, my complaint and the CNE inspection are not only about that, but also about the other tree (sic) approximately 10 meters away that is affecting my property through its roots, which have made holes in my house, and additionally because that water is stormwater and of other types that are not enclosed in pipes, and over the years what was an insignificant channel now has larger dimensions because it has not been properly enclosed in pipes and is being used indiscriminately by properties and condominiums further upstream from our homes.

I do not need to be told what I already know (sic) — I am referring to page 2 of the attached PDF — but rather the final solution to the problem.

Once again I note that the green area beside my property previously measured N number of meters; now it measures 4x7 (…)." (See documentary evidence.)

  • j)On May 31, 2021, a Municipalidad de Alajuela official sent an email to "Lawrence Chacón Soto; Juan José Moya Argüello," in which he stated: "Regarding the attention and follow-up on the complaint filed by Ms. Alejandra Cháves Cháves (initial filing no. 25465-2020), and in accordance with the relevant superior instructions, I ask that you take note of the observations made by the taxpayer in the attached email, all with the purpose of scheduling a new site visit and inspection and assessing possible actions where applicable." (See documentary evidence.)
  • k)On November 22, 2021, the respondent authorities were served notice of the order admitting this amparo proceeding. (See notification records.)
  • l)On November 23, 2021, a Cantonal Risk Prevention and Management official from the respondent local government issued official memorandum MA-PPCI-PGRC-0752-2021, in which he stated:

"(…) 1. On November 2, 2020, four emergency incidents were generated in the 9-1-1 System (2020-11-02-00432, 2020-11-02-00455, 2020-11-02-00726, and 2020-11-03-00396), indicating the fall of a large tree onto a drainage ditch (acequia) running at the end of Dirección02, in Desamparados, specifically 300 m northwest and 200 m east of the La Carreta restaurant (…)

2. On November 3, 2020, a site inspection was conducted to verify what had occurred, and a large tree was found that posed a risk of obstructing the water body (cuerpo de agua), in addition to a significant soil slide caused by ground saturation in the preceding days.

3. As a result, official memorandum MA-PPCI-PGRC-0704-2020 was generated and sent to the Stormwater Drainage Activity, which — pursuant to that office's own functions, namely the "Cleaning of water body channels" — was requested to use its good offices in addressing the situation, given that the site presented the need for urgent intervention, as failure to act would endanger the lives of persons residing in the area.

Likewise, a copy of said memorandum was sent to the Municipal Security and Traffic Control Process so that certain abandoned vehicles on the public roadway could be addressed; a copy was also forwarded to the Environmental Management Sub-Process (Subproceso de Gestión Ambiental) and to the Ministerio de Ambiente y Energía for the relevant action.

4. On November 5, 2020, official memorandum MA-SGV-741-2020 was received from the Environmental Management Sub-Process, indicating that, based on a site inspection, the tree is located within the protection zone (zona de protección) of the water body; therefore, issuing an opinion on the matter was outside the competence of that office, in accordance with the provisions of the Ley Forestal, and recommending that the case be forwarded to the SINAC-MINAE directorate in Alajuela for the relevant action.

5. On November 11, 2020, official communication (oficio) OA-1207 was received from SINAC-MINAE of Alajuela, indicating that a site visit had been conducted, where the tree species found was Poró, which was leaning toward the channel (cauce) of Quebrada Targuá, located on the left bank (ribera) of the quebrada; they also noted that a large quantity of automotive debris was observed, which threatened to slide into the channel of the quebrada.

In view of the foregoing, that agency's recommendations and conclusions state that, since an automotive repair shop is located within the 10-meter protection zone (área de protección) of Quebrada Targuá — an activity that negatively impacts the soil without allowing it to recover — the appropriate measures will be taken in accordance with current legislation, in addition to issuing an administrative notice (prevención administrativa) to the property owner so that the relevant corrective measures are applied immediately; and should this be ignored, the report will be referred to the Office of the Public Prosecutor (Ministerio Público), while also indicating that follow-up action will be taken to ensure proper compliance.

6. On November 19, 2020, official communication MA-PSMCV-1045-2020 was received from the Municipal Security and Traffic Control Unit, indicating that a site visit was conducted, during which the vehicle owners were spoken with and given a 48-hour period starting November 6 of that month; following which, during a visit on November 19, it was confirmed that the abandoned vehicles had already been removed from the public road (vía pública) by their owners, thereby partially addressing the situation described regarding the vehicles located on the public road.

7. On November 20, 2020, report CNE-UIAR-U986-2020 was received from the Risk Research and Analysis Unit of the National Emergency Commission (Comisión Nacional de Emergencias), a report generated at the request of Ms. Alejandra Chaves; it is noted that at the time of inspection the tree in question was still observed, having fallen near the body of water, possibly due to erosion of the banks (márgenes) of that body of water; they also indicate that the erosion of the channel has directly endangered a structure apparently being used as a workshop, where debris was also observed, and which is located less than 10 meters from the channel.

In response, the conclusions state that the tree in the channel poses a risk, as it could cause damming (represamiento) if not removed; furthermore, the lack of protection on the banks of the channel and the large volume of water collected from the upper area have increased the erosive force and the damage, and that if the channel is not intervened upon and a protective works structure built to prevent erosion of the channel, the hillside will continue to be undermined and will in the future endanger both the dwelling and the workshop.

Finally, in its recommendations, CNE indicates that the municipality must, in the short term, remove the fallen tree to prevent damming of the channel, in addition to evaluating the possibility of constructing a structure to protect the banks and thereby prevent erosion, such as the implementation of retention ponds (lagunas de retención) to reduce vulnerability to flooding.

8. On December 17, 2020, proceeding (trámite) N°25465-2020 was received, submitted by Ms. Alejandra Chaves, in which she sets out the need for intervention in the channel through the removal of the fallen trees, which pose a danger at the stormwater (aguas pluviales) outlet near her home, given the danger it represents in view of the following year's rainy season.

In view of the foregoing, and given the need for investment at the site, on January 6, 2021, official communication MA-PPCI-PGRC-0023-2021 was forwarded to the Stormwater Drainage (Alcantarillado Pluvial) Unit, enclosing copies of the reports cited above, and indicating that the problem persists and that the matter must be addressed on a priority and urgent basis, while remaining available for any requirements related to addressing it; but at that time no such need [arose] (sic), and this addressed what Ms. Chaves had requested in her complaint.

9. On March 9, 2021, by email, Ms. Chaves, dissatisfied with the actions taken, indicated that she had met with Licenciado Alonso Villalobos of the Mayor's Office (Alcaldía), who indicated (sic) that he would assist her with the management of the matter.

10. On May 20, 2021, through official communication MA-A-2591-2021, Licenciado Alonso Villalobos, advisor to that office, forwarded for appropriate action a copy of official communication MA-PPCI-PGRC-0023-2021 issued by this Unit, along with a copy of trámite N° 25465-2020 submitted by Ms. Chaves, to the Public Investment Works Sub-unit (Subproceso de Obras de Inversión Pública) and the Stormwater Drainage Unit, so that the appropriate intervention at the site be carried out definitively and as soon as possible.

11. On May 26, 2021, through official communication MA-AAP-0435-2021, the Stormwater Drainage Unit informed ONLY the Mayor's Office that in the first weeks of December it had addressed the matter and cut down most of the fallen tree, leaving only the trunk at the site, with the obstructions and fallen branches removed; however, the trunk risks falling should the bank of the channel erode, due to its large size; they also indicate that, owing to the trunk's dimensions, weight, and position, it was not possible to remove it using municipal equipment or machinery (…)

12. On May 31, 2021, through official communication MA-A-2732-2021, the Municipal Mayor's Office notified Ms. Chaves of the matter and forwarded a copy of the Stormwater Drainage Unit's official communication; however, Ms. Chaves indicated by email that the municipality had indeed carried out the removal, but that with the trunk remaining in the ground it continues to live and is sprouting new branches, and that, being in a horizontal position, there are branches growing downward as well.

Furthermore, as noted in point 8 of this report, part of the complaint of Ms. Nombre02 concerned a stormwater problem near her home, which apparently was not properly channeled and which, over the years, has caused the channel to grow larger due to a lack of proper channeling, hence her reference to the need for intervention in this additional problem.

Finally, it is important to note that hiring machinery through CNE solely for the removal of said tree would be unfeasible: first, because of the location of the site, and second, because a company with heavy machinery (Pala Excavadora) would not undertake a task that can be completed in under two hours, given that the logistics of transporting and positioning such machinery are complex.

Technically, requesting such machinery is unfeasible; what is suggested is the removal of said tree through a special contract to cut it into smaller sections, which can then be efficiently extracted.

Therefore, this Unit has carried out all pertinent actions to address the problems arising in the area, and, as stated in previous documents, we remain available to collaborate with the Stormwater Drainage Department in any efforts required for the comprehensive management of the area, whether through seeking resources for adequate attention or through any additional requirements necessary for a definitive intervention." (See documentary evidence).

  • m)On November 23, 2021, the coordinator of Stormwater Drainage and the director of Infrastructure Planning and Construction of the Municipalidad de Alajuela issued official communication MA-AAP-0954-2021, in which they expressed the following:

"(…) 3. Due to increased precipitation conditions, all channels have undergone significant changes in their behavior, caused, according to experts, by climate change, which has produced rainfall of greater intensity and duration — a factor entirely exogenous to the Municipalidad de Alajuela.

However, it is necessary to note that the Municipalidad de Alajuela has been proactive in stormwater management for real estate projects and construction developments in general, and for more than 10 years it has required, as a condition for granting the approval certificate (Visto Bueno) for stormwater discharge for any large-scale construction project, the establishment of a stormwater management plan, which in most cases (nearly all) includes the construction of stormwater retention systems (…)

In this case, the area that the appellant (recurrente) describes as 'el fundo de la zona verde' corresponds to the protection zone (zona de protección) of Quebrada Targuá, within which no construction of any kind is permissible, as established by law.

6. In the northeastern boundary (colindancia) of urbanización El Valle, there is a lot through which the stormwater discharge for the 'Condominio Azul' project was approved, which complies with the guidelines established by the Municipalidad de Alajuela, including the establishment of a stormwater management plan — in this case, the construction of a water retention tank (tanque de retención) with a capacity of 415.90 m³, as noted by Ms. Chaves Chaves in her Amparo petition (Recurso de Amparo).

7. Regarding the appellant's request to 'pipe that water passage,' it is necessary to note that natural channels, by their nature, should not be piped (except in special cases), since that process (of piping) eliminates the flora and fauna that may thrive in the protection zone, which was created primarily for the preservation of nature (…)

10. Regarding any erosion that the appellant's property may have experienced, this could be attributable to natural factors such as a change in the course of the quebrada (which could have originated from a seismic event, sedimentation of the channel at some point, or other causes), or to encroachment upon the protection zone, in which case it would fall to other institutions to determine the condition of the appellant's property and structures.

11. As for the impact of tree roots, it is difficult to determine with certainty which (sic) tree or trees (sic) have roots that reach the property of Ms. Chaves Chaves; thus, to take any action in this regard, all trees located in the quebrada's protection zone and adjacent to the affected property would have to be felled — a situation that would in turn negatively impact the very nature of protection zones" (bold added). (See documentary evidence).

  • n)On November 24, 2021, the coordinator of the Construction Control Unit (Actividad de Control Constructivo) of the Municipalidad de Alajuela issued official communication MA-ACC-4710-2021, in which the following was detailed:

"(…) 3. It is established that the complainant's (denunciante) property corresponds to property registry number (finca matrícula) 2-242586-000, cadastral plan (plano catastrado) A-842537-1989, adjoining the protection zone of Quebrada Targuá; hence, Ms. Chaves refers to the bank of the quebrada as a 'caño' (drainage ditch), which includes a portion of land under property registry number 2-176431-000, cadastral plan registered in the name of the Asoc. Desarrollo Integral Bella Vista Alajuela.

4. With respect to the problem reported by Ms. Alejandra Chaves, we consider it appropriate to coordinate with the Stormwater Drainage departments and the Municipal Risk Management and Prevention Office in order to follow up on the work carried out at the site, as these matters fall within their respective areas of competence.

Taking into consideration the arguments presented by the neighboring residential developments (desarrollos habitacionales), these have fully complied with the applicable regulations, and all documentation is incorporated in the various administrative files.

That said, it will be the relevant technical departments that will provide the information and the solution to the problem of water discharge — including not only stormwater (aguas pluviales) and greywater (aguas jabonosas) but also sewage (aguas negras) — as indicated in the written submission presented by Ms. Chaves Chaves (…)". (See documentary evidence).

IV. ON THE SPECIFIC CASE

In the sub lite, the appellant (recurrente) states that she owns a residence in the residential development (urbanización) El Valle in Desamparados de Alajuela. She adds that, due to the large number of residential complexes built in the area, the stream (arroyo) running near her home has increased considerably in volume, as it now carries not only stormwater but also greywater and sewage, which during the dry season stagnate and cause foul odors and mosquito proliferation. She explains that the volume of water flowing through the channel has caused severe erosion, and that 2 trees standing alongside the watercourse (cauce) have even fallen. She states that on 24 November 2020 she filed a complaint with the Municipalidad de Alajuela, through which she requested: "(…) that the second tree be cut down and that both be removed and taken out of the drainage channel (caño) [sic], because if it rains heavily it will fill up and our houses could flood, and second, please pipe that water passage, which appears to be stormwater and greywater, to prevent it from continuing to wash away land, in addition to the already mentioned odors and pests (…)".

She claims that, given the local government's inaction in resolving the described situation, new difficulties have since arisen. She recounts that in November 2020, the CNE issued three recommendations directed to the aforementioned municipality regarding the reported problem; however, these have not received proper follow-up, nor has the problem been resolved.

The Chamber finds that the petitioner (accionante) is the owner of a residence located in the residential development El Valle in Desamparados de Alajuela. Likewise, it is established that on 17 November 2020 — with a date received of 24 November 2020 — the protected party (amparada) filed a request with the Municipalidad de Alajuela, which was assigned filing number 25465-2020, in which she stated: "I write to you through this means to seek a solution to certain difficulties that have arisen alongside my home. Allow me to describe a little of what has happened. Our home was at a distance of 10 linear meters from the drainage channel to the house, and that plot corresponds to the green area (zona verde) of the residential development. Over the years, and due to the residential complexes built in recent years to the northeast of the property, the volume of water flowing through that drainage channel [sic] has increased.

This water, it should be mentioned, stagnates in the dry season, causing foul odors and pests such as Dengue — and indeed my nephews have already suffered from it. This problem does not only concern me and my family but [sic] also all of us who live in this locality. In recent years, these volumes of water have caused the land to subside and the drainage channel [sic] to become much larger, to the point that the plot now measures 6 linear meters. Additionally, there have always been 2 fairly large trees whose roots have reached great depth; one of them fell on 2 November of this year onto the bed of the drainage channel [sic] and carried with it a great deal of earth, three cars, and part of the end of the street. The other tree, whose roots are affecting my property, has already made a cracking sound and is about to fall; if this happens, it will significantly damage my home due to the roots.

We need 2 things: first, that the second tree be cut down and that both be removed and taken out of the drainage channel [sic], because if it rains heavily it will fill up and our houses could flood; and second, please pipe that water passage, which appears to be stormwater and greywater, to prevent it from continuing to wash away land, in addition to the already mentioned odors and pests. For any questions, you may write to me at 86709872, my name is Alejandra Chaves Ch. I appreciate any support you can provide and remain attentive to possible solutions and the estimated timeframe for addressing this matter." (emphasis added).

This Tribunal finds it established that on 19 November 2020, the CNE issued technical report (informe técnico) CNE-UIAR-INF-0986-2020, "Assessment of Flood Risk and Land Instability Due to Tree Collapse in Watercourse," in which it was stated: "I. General Information At the request of the interested party, a visual risk assessment was carried out in Desamparados de Alajuela on 12 November, regarding the erosion of a watercourse that led to the collapse of a tree (…) V. Conclusions A. The erosion of the watercourse apparently undermined [sic] the tree's roots, causing it to collapse. B. Based on field observations and analysis of the map and aerial photographs, this watercourse is not natural and is a drainage system (alcantarillado) that collects water from the residences in the upper part of the watershed (cuenca). C. The lack of protection along the banks (márgenes) of the watercourse and the large volume of water collected from the upper part have increased erosive force and damage.

D. The tree in the watercourse poses a risk as it could cause damming (represamiento). E. If the watercourse is not addressed and a protective structure is not built to prevent erosion, the channel will continue to undermine the slope and may in the future jeopardize the residence and the workshop. VI. Recommendations A. The Municipality must, in the short term, remove the fallen tree to prevent damming. B. It must also evaluate the possibility of constructing a structure to protect the banks so as to prevent further erosion, and implement retention ponds (lagunas de retención) to reduce the risk of overflow. C. Any work to be carried out must be done under the supervision of a qualified professional and must be supported by the corresponding technical studies (…)" (emphasis added). Said report was served on the respondent municipal corporation (corporación municipal) on 20 November 2020.

Likewise, it is established that on 6 January 2021, officials from the Planning and Infrastructure Construction Process of the Municipalidad de Alajuela sent memorandum MA-PPCI-PGRC-0023-2021 to the coordinator of the Stormwater Drainage (Alcantarillado Pluvial) Division, in which they stated: "(…) Filing #25465-2020 is hereby forwarded for your attention, along with copies of memoranda MA-PSMCV-1045-2020, MA-SGA-741-2020, CNE-UIAR-INF-0986-2020, and OA-1207, which correspond to a matter already referred to your office since 03 November 2020 through memorandum MA-PPCI-PGRC-0704-2020. In light of the foregoing, a new inspection of the site was conducted, finding that the problem at the site persists; accordingly, your assistance is requested in addressing the matter and providing a response to those affected [sic], as the site is currently in need of PRIORITY and URGENT intervention. It should be noted that we are willing to collaborate in managing this matter, either through technical supervision of the works or, failing that, through the relevant procurement process, provided that [sic] the necessary resources are available." (emphasis added).

For its part, on 20 May 2021, an official of the Municipalidad de Alajuela sent memorandum MA-A-2591-2021 to Lawrence Chacón Soto, Kasey Palma Chavarría, and Juan José Moya Argüello, respectively the coordinator of the Stormwater Drainage Division, the coordinator of the Public Investment Works Sub-Process, and the officer for Cantonal Risk Prevention and Management. In that memorandum, with regard to filing No. 25465-2020 and the terms of memorandum MA-PPCI-PGRC-00232021, the following was requested: "Immediately establish communication and coordination on this matter among the relevant departments and professionals, so that — through whatever actions prove appropriate — the necessary intervention at the site be definitively carried out as soon as possible." Meanwhile, on 25 May 2021, the Stormwater Drainage coordinator of the respondent local government issued memorandum MA-AAP-0435-2021 addressed to the mayor (alcalde) of Alajuela regarding the complaint filed by the protected party (tutelada), in which he stated that: "this department carried out the removal of the tree that was located within the channel and was obstructing the flow of stormwater, all of which was done during the first week of December 2020.

It should be clarified that only the main trunk remains unremoved [sic]; however, it does not affect the passage of water given the height at which it sits, and due to its size, weight, and position we do not possess the machinery or equipment required for its extraction." (emphasis added).

This Chamber finds that on 28 May 2021, an advisor of the Municipalidad de Alajuela sent memorandum MA-A-2732-2021 to the protected party, informing her that, in response to complaint No. 25465-2020, memorandum MA-AAP-0435-2021 was attached "which contains a report on the work performed and water management matters. At the same time, a copy of this memorandum is being sent to that department requesting that it maintain follow-up on the matter of concern." Thus, on 31 May 2021, the respondent municipal corporation notified the protected party via email of memorandum MA-A-2732-2021 concerning the response to complaint No. 25465-2020. She was also informed that "the relevant department is being asked to maintain follow-up on the situation." As a result of the foregoing, on 31 May 2021 the protected party sent an email to an official of the respondent local government, in which she stated: "(…) Indeed, they did carry out part of the removal, but since the trunk remains on the ground it is still alive and is once again sprouting branches, and since it is in a horizontal position, branches will also grow downward.

Moreover, my complaint and the CNE inspection are not only about that, but also about the other tree [sic] that is approximately 10 meters away and is affecting my property through its roots, which have created a cavity in my home, and additionally because those waters [sic] are stormwater and of another type that are not piped, and over the years what was an insignificant drainage channel now has larger dimensions due to not being properly piped and being used indiscriminately by properties and condominiums upstream from our homes. I do not need to be told what I already know [sic] — I am referring to page 2 of the attached PDF — but rather the final solution to the problem. I again state that before, the green area next to my property measured N meters; now it is 4x7 (…)" (emphasis added). This being the case, on 31 May 2021, an official of the Municipalidad de Alajuela sent an email to "Lawrence Chacón Soto; Juan José Moya Argüello," stating: "Regarding the handling and follow-up of the complaint filed by Ms.

Alejandra Cháves Cháves (initial filing No. 25465-2020), pursuant to the superior instructions in this matter, I ask that you take note of what the taxpayer has indicated in the attached email, with the aim of scheduling a new visit and inspection of the site and evaluating possible actions if appropriate." (emphasis added).

After the respondent authorities were notified of the order admitting this appeal — November 22, 2021 — the Court observes that, on November 23, 2021, an official from the Cantonal Risk Prevention and Management unit of the respondent local government issued official memorandum MA-PPCI-PGRC-0752-2021, in which the following was stated: "(…) 1. On November 2, 2020, four emergency incidents were generated in the 9-1-1 System (2020-11-02-00432, 2020-11-02-00455, 2020-11-02-00726, and 2020-11-03-00396), reporting the fall of a large tree onto a drainage ditch (acequia) running at the end of Dirección02, in Desamparados, specifically 300m northwest and 200m east of the restaurant La Carreta (…) 2. On November 3, 2020, an inspection of the site was conducted, which confirmed the reported situation and identified a large tree at risk of obstructing the body of water (cuerpo de agua), along with a significant collapse of material resulting from soil saturation over the preceding days. 3.

As a result, official memorandum MA-PPCI-PGRC-0704-2020 was issued and forwarded to the Stormwater Drainage Unit (Actividad de Alcantarillado Pluvial), requesting its good offices in the matter pursuant to that unit's own functions, specifically the 'Cleaning of watercourse channels (cauces de cuerpos de agua),' given the urgent need for intervention at the site, since failure to address the situation placed the lives of residents in the area at risk. Likewise, a copy of said memorandum was sent to the Municipal Security and Traffic Control Process (Proceso de Seguridad Municipal y Control Vial) so that action could be taken regarding abandoned vehicles found on the public road; a copy was also forwarded to the Environmental Management Sub-process (Subproceso de Gestión Ambiental) and to the Ministry of Environment and Energy (Ministerio de Ambiente y Energía) for appropriate action. 4. On November 5, 2020, official memorandum MA-SGV-741-2020 was received from the Environmental Management Sub-process, indicating that, upon inspection of the site, the tree was found to be located within the protection zone (zona de protección) of the body of water, and that issuing an opinion on the matter fell outside that unit's competence pursuant to the Ley Forestal; accordingly, it recommended forwarding the case to the SINAC-MINAE directorate in Alajuela for appropriate action. 5.

On November 11, 2020, official memorandum OA-1207 was received from SINAC-MINAE of Alajuela, reporting that a site visit had been conducted during which the tree species was identified as Poró, leaning toward the channel (cauce) of the Quebrada Targuá and located on the left bank (ribera izquierda) of the stream; additionally, a large quantity of automotive waste was observed, which threatened to slide into the channel. Accordingly, in its recommendations and conclusions, that office indicated that, since an automotive repair shop was located within 10 m of the protection area (área de protección) of the Quebrada Targuá — an activity that negatively impacts the soil without allowing it to recover — it would proceed in accordance with applicable legislation and would issue an administrative notice (prevención administrativa) to the property owner requiring the immediate application of corrective measures; it further indicated that, in the event of non-compliance, the matter would be referred to the Public Prosecutor's Office, and that follow-up would be conducted to ensure proper resolution. 6.

On November 19, 2020, official memorandum MA-PSMCV-1045-2020 was received from the Municipal Security and Traffic Control Process, indicating that a site visit had been conducted during which the vehicle owners were spoken to and given a 48-hour period commencing November 6 to remove their vehicles; upon a subsequent visit on November 19, it was confirmed that the abandoned vehicles had already been removed from the public road by their owners, thereby partially resolving the situation described with respect to vehicles occupying the public road. 7. On November 20, 2020, report CNE-UIAR-U986-2020 was received from the Risk Research and Analysis Unit of the National Emergency Commission (Comisión Nacional de Emergencias), CNE, a report generated following a request submitted by Ms. Alejandra Chaves; it stated that at the time of the inspection the tree was still present at the site, having fallen near the body of water, possibly due to erosion of the banks (márgenes) of that body of water; it also indicated that the channel erosion had placed at direct risk a structure apparently being used as a workshop, where refuse was also observed, and which was located less than 10 m from the channel.

In its conclusions, the report indicated that the tree in the channel posed a risk because, if not removed, it could cause a damming (represamiento) of the channel; furthermore, the lack of bank protection and the large volume of water flowing in from the upper part of the watershed had increased the erosive force and the resulting damage, and that, if the channel were not addressed and a protective structure built to prevent channel erosion, the hillside (ladera) would continue to be undermined, eventually placing both the residential dwelling and the workshop at risk. Finally, in its recommendations, CNE indicated that the municipality should, in the short term, remove the fallen tree to prevent damming of the channel, and should also evaluate the possibility of constructing a structure to protect the banks, thereby preventing erosion, as well as implementing retention ponds (lagunas de retención) to reduce vulnerability to flooding. 8.

On December 17, 2020, administrative filing (trámite) N°25465-2020 was received, submitted by Ms. Alejandra Chaves, in which she set forth the need for intervention in the channel through the removal of the fallen trees, which she identified as a hazard to the stormwater (aguas pluviales) outlet near her home, given the danger it would pose during the following year's rainy season. As a result, and in view of the need for intervention at the site, on January 6, 2021, official memorandum MA-PPCI-PGRC-0023-2021 was forwarded to the Stormwater Drainage Unit, enclosing copies of the reports cited above, noting that the problem persisted and that the matter required priority and urgent attention, and stating that the unit would remain available for any additional requirements to address it, although at that time no such need had (sic) arisen. This served to address Ms. Chaves's request as presented in her submission. 9.

On March 9, 2021, through an email, Ms. Chaves, dissatisfied with the actions taken, reported that she had met with licenciado Alonso Villalobos of the Mayor's Office, who indicated (sic) that he would assist her in following up on the matter. 10. On May 20, 2021, through official memorandum MA-A-2591-2021, licenciado Alonso Villalobos, adviser to that office, forwarded for appropriate action a copy of official memorandum MA-PPCI-PGRC-0023-2021 issued by this Process, along with a copy of trámite N° 25465-2020 submitted by Ms. Chaves, to the Public Investment Works Sub-process (Subproceso de Obras de Inversión Pública) and the Stormwater Drainage Unit, so that the required intervention at the site could be definitively carried out as soon as possible. 11. On May 26, 2021, through official memorandum MA-AAP-0435-2021, the Stormwater Drainage Unit informed the Mayor's Office EXCLUSIVELY that during the first weeks of December it had addressed the situation by cutting a large portion of the fallen tree, leaving only the trunk at the site and eliminating the obstructions and fallen branches; however, the trunk risked falling if the channel bank were to erode further, given its large size; the unit also reported that, due to the trunk's dimensions, weight, and position, it had not been possible to remove it using municipal equipment or machinery (…) 12.

On May 31, 2021, through official memorandum MA-A-2732-2021, the Municipal Mayor's Office notified Ms. Chaves of the situation and forwarded a copy of the Stormwater Drainage Unit's memorandum; however, Ms. Chaves replied by email indicating that the municipality had indeed carried out the removal, but that with the trunk remaining in the ground the tree was still alive and was again producing branches, and that, given its horizontal position, some branches were also growing downward. Furthermore, as mentioned in point 8 of this report, part of the complaint filed by Ms. Nombre02 related to a stormwater problem near her home, waters that appear not to have been properly channeled and that, over the years, have caused the channel to grow in size due to the lack of proper channeling; accordingly, she raised the need for intervention to address this additional problem. Finally, it is important to highlight that contracting machinery through CNE solely for the removal of the tree would not be feasible: first, because of the location of the site, and second, because a company owning heavy machinery (excavator (Pala Excavadora)) would not take on a task that can be completed in less than two hours, given the logistical complexity of transporting and positioning such equipment.

Requesting such machinery is technically unfeasible; what is instead recommended is the removal of the tree through a special procurement contract for its cutting into smaller sections, which can in turn be efficiently extracted. Therefore, this Process has carried out all pertinent actions to address the problems arising in the area; as stated in previous documents, we remain available to collaborate with the Stormwater Drainage Department in whatever measures are required for the comprehensive care of the area, whether through the search for resources for proper attention or through any additional requirement necessary for a definitive intervention" (emphasis added).

Whereas, on November 23, 2021, the coordinator of Stormwater Drainage (Alcantarillado Pluvial) and the director of Infrastructure Planning and Construction of the Municipalidad de Alajuela issued official memorandum (oficio) MA-AAP-0954-2021, in which they stated: "(…) 3. Due to increased precipitation conditions, all watercourses (cauces) have undergone significant changes in their behavior—caused, according to experts, by climate change, which has generated rainfall of greater intensity and duration, a factor entirely exogenous to the Municipalidad de Alajuela. However, it must be noted that the Municipalidad de Alajuela has been proactive in stormwater management (manejo de las aguas pluviales) for real-estate projects or construction developments in general, and for more than 10 years has required, as a prerequisite for approval of the stormwater discharge clearance (Visto Bueno de descarga de aguas pluviales) for all large-scale construction projects, the establishment of a stormwater management plan (plan de manejo de aguas pluviales), which in most cases (nearly all) require the construction of stormwater retention systems (sistemas de retardo) (…) In this case, the area that the appellant (recurrente) describes as 'the green-area parcel' (el fundo de la zona verde) corresponds to the protection zone (zona de protección) of the quebrada Targuá; within that zone, no type of construction is feasible, as established by the applicable regulations. 6.

That, on the northeastern boundary of the urbanización El Valle, there is a parcel through which the stormwater discharge for the project 'Condominio Azul' was approved—a project that complies with the guidelines established by the Municipalidad de Alajuela, including the establishment of a stormwater management plan, in this case the construction of a retention tank (tanque de retención) with a capacity of 415,90m3, as noted by Ms. Chaves Chaves in her constitutional protection writ (Recurso de Amparo). 7. Regarding the appellant's request that 'that water passage be piped,' it must be noted that natural watercourses, by their nature, should not be piped (except in special cases), because that process (of piping) eliminates the flora and fauna that may thrive in the protection zone, which was established primarily for the preservation of nature (…) 10. Regarding the erosion that the appellant's property may be undergoing: this could be attributable to natural factors such as a change in the course of the watercourse (which could originate from a seismic event, sediment buildup at some point in the channel, or other causes), or, if there is an encroachment upon the protection zone, other institutions would be responsible for determining the condition of the appellant's property and structures. 11.

As for the damage caused by tree roots, it is virtually impossible to determine with certainty which tree or trees have roots reaching the property of Ms. Chaves Chaves; accordingly, in order to take any action in this regard, all trees located in the protection zone adjacent to the affected property would have to be felled—a situation that would, conversely, harm the nature of the protection zones" (emphasis added).

On the other hand, on November 24, 2021, the coordinator of the Building Control Division (Actividad de Control Constructivo) of the Municipalidad de Alajuela issued official memorandum MA-ACC-4710-2021, in which he detailed: "(…) 3. It is established that the complainant's property corresponds to cadastral property (finca matrícula) 2-242586-ooo, cadastral plan (plano catastrado) A-842537-1989, adjacent to the protection zone of the quebrada Targuá; hence, Ms. Chaves refers to the bank of the watercourse as a 'drainage channel' (caño)—this bank includes a portion of land under cadastral property registration -coo, cadastral plan registered in the name of the Asoc. Desarrollo Integral Bella Vista Alajuela. 4. With respect to the problem reported by Ms. Alejandra Chaves, we consider it pertinent to coordinate with the Stormwater Drainage departments and the Municipal Risk Management and Prevention Office in order to follow up on the work carried out on site, as these matters fall within their respective areas of competence.

Taking into account the arguments put forward regarding the neighboring residential developments, those developments have fully complied with the applicable regulations, and all documentation is incorporated in the various administrative files. The relevant technical departments will provide the information and the solution to the problem of discharges of not only stormwater and soapy water but also blackwater (aguas negras), as indicated in the brief submitted by Ms. Chaves Chaves (…)." In light of the foregoing, this Constitutional Chamber (Cámara Constitucional) finds a violation (conculcación) of the fundamental rights of the protected party (parte tutelada), due to the delay by the Municipalidad de Alajuela in providing a definitive solution to the problem reported since November 2020. In this regard, the Chamber notes that, on November 17, 2020—received on November 24, 2020—the protected individual (amparada) filed a complaint with the respondent municipal corporation (corporación municipal), in which she stated that near her home there is a drainage channel whose waters become stagnant and generate foul odors, and whose flow has increased to such an extent that it has caused erosion on the land.

Likewise, the petitioner (accionante) stated that in that location there are two trees posing a risk of falling, which could cause flooding and damage her home. She therefore requested "that that second tree be cut and that both be removed and taken out of the drainage channel, because if it rains heavily it would fill up and our homes could be flooded, and secondly, that that water passage, which appears to carry stormwater and soapy water, please be piped to prevent it from continuing to wash away the land, in addition to the already-mentioned odors and pests." Also relevant to the resolution of this matter, on November 19, 2020—notified to the Municipalidad de Alajuela the following day—the CNE issued technical report CNE-UIAR-INF-0986-2020, "Flood Risk and Land Instability Assessment Due to Tree Collapse in a Watercourse," in which it was stated: "I. General Information At the request of the interested party, on November 12 a visual risk assessment was conducted in Desamparados de Alajuela, concerning the erosion of a watercourse that led to the collapse of a tree (…) V. Conclusions A. Apparently, erosion of the watercourse undermined the roots of the tree and caused its collapse.

B. Based on field observations and analysis of the map and aerial photographs, this watercourse is not natural and is a drainage system (alcantarillado) that collects water from the homes in the upper part of the watershed (cuenca). C. The lack of protection of the channel banks (márgenes del cauce) and the large volume of water collected from the upper part have increased the erosive force and the damage. D. The tree in the watercourse poses a risk as it could cause damming (represamiento). E. If the watercourse is not addressed and a protective work is not constructed to prevent erosion, the channel will continue to undercut the slope and will eventually endanger the home and the workshop. VI. Recommendations A. The Municipalidad must, in the short term, remove the fallen tree to prevent damming. B. It should also evaluate the possibility of constructing a work to protect the banks to prevent further erosion and implement retention ponds (lagunas de retención) to reduce the vulnerability to flooding. C. Any work carried out must be under the supervision of a qualified professional and supported by the corresponding studies (…)" (emphasis added).

In this way, as of November 20, 2020, the CNE—namely, the governing entity with respect to risk prevention and emergency preparedness (ley n.° 8488)—indicated that the watercourse located near the appellant's home is not natural, but rather a drainage system that collects water from the homes in the upper part of the watershed, and that the lack of protection of the channel banks has increased the erosive force. Likewise, the CNE was emphatic in stating that "If the watercourse is not addressed and a protective work is not constructed to prevent erosion, the channel will continue to undercut the slope and will eventually endanger the home and the workshop." Consequently, the CNE recommended that the Municipalidad de Alajuela remove the fallen tree as of November 2020, as well as evaluate the possibility of constructing a protective work for the banks and implementing retention ponds.

In view of the problem that arose and the statements made by both the appellant and the CNE, this Chamber verifies that the Municipalidad de Alajuela undertook various actions, including coordination with SINAC and the partial removal of the tree that had fallen since November 2020. For example, on May 25, 2021, the Stormwater Drainage coordinator of the respondent local government (gobierno local) issued official memorandum MA-AAP-0435-2021, addressed to the mayor (alcalde) of Alajuela concerning the complaint filed by the protected individual, in which he stated: "this department carried out the removal of the tree found within the channel, which was obstructing the flow of stormwater, during the first week of December 2020. It should be clarified that only the main trunk was left unremoved; however, it does not affect the passage of water given its height, and due to its dimensions, weight, and position, we do not possess the machinery or equipment to extract it." However, it should be noted that, as of May 31, 2021, the protected individual complained to the Municipalidad de Alajuela that the work carried out had not resolved the reported problem.

On that date, the appellant stated: "(…) Indeed, they did carry out part of the extraction, but since the trunk remains on the ground it is still alive and is sprouting branches again, and being in a horizontal position, branches will also grow downward. Moreover, my complaint and the CNE inspection are not only about that. But also about the other tree (alborí (sic)) approximately 10 meters away, which is affecting my property through its roots, which have made holes in my house, and additionally because that water is stormwater and another type that is not piped, and over the years what was an insignificant drainage channel today has greater dimensions because it has not been properly piped and is being used indiscriminately by properties and condominiums further up from our homes. I don't need to be told what I already know—I mean page 2 of the attached PDF. I need the final solution to the problem. I again note that before the green area (zona verde) adjacent to my property it measured N meters, now it is 4x7 (…)" (emphasis included).

On this matter, while the Chamber notes that, in response to the new complaint filed by the petitioner, an official from the Municipalidad de Alajuela sent an email to various departments of the local government requesting a new site visit and an assessment of possible actions to be undertaken, it is equally true that this Tribunal finds no evidence that the respondent municipality carried out any further action to resolve the problems reported by the protected individual.

In sum, even though it is established in this case at hand (sub iudice) that the respondent authorities have carried out a series of actions aimed at addressing the problem reported by the protected party (amparada), such as the partial removal of one of the trees located near her home, it is nonetheless not established that the entirety of the problem reported by the protected party has been duly addressed and remedied. Consequently, in this matter, the risk situation reported by the moving party remains in place with respect to the threat posed by the trees whose roots were undermined by the streambed (cauce), as well as by the erosion suffered along the banks of that streambed. This situation is further aggravated by the fact that CNE noted as early as November 2020 that "Should the streambed not be intervened upon and a protective work carried out to prevent erosion, the channel will continue to undermine the slope and will eventually put the home and the workshop at risk." Therefore, the appropriate course of action is to grant the constitutional protection writ (recurso de amparo) in the terms set forth in the operative part (parte dispositiva) of this ruling.

Finally, the Tribunal does not fail to note that the protected party's claim regarding compensation for the alleged damages suffered to her home must be addressed through ordinary legal channels (vía de legalidad ordinaria) and not before this specialized jurisdiction.

V. NOTE OF JUSTICE SALAZAR ALVARADO

In environmental matters, it is the opinion of the undersigned that, where there has already been intervention by the Public Administration, jurisdiction and resolution of the matter belongs to the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). However, the undersigned does proceed to examine the merits of a matter when other rights of the persons affected by the source of contamination (foco de contaminación) are at stake, including the right to health, quality of life, and the right to enjoy a healthy and pollution-free environment (article 50 of the Constitución Política), as is the case here, in which it is alleged that the stream passing near the protected party's home has considerably increased its flow (caudal), carrying not only stormwater (aguas pluviales) but also gray water (aguas jabonosas) and black water (aguas negras), which during the dry season become stagnant and cause foul odors and mosquito proliferation — a situation that may eventually affect the health of the protected party and his family, in violation of the right to enjoy a healthy and ecologically balanced environment and a dignified quality of life.

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby notified that if any documents in paper form, as well as objects or evidence contained in any additional electronic, computing, magnetic, optical, telematic, or new-technology device, have been submitted, said materials must be retrieved from the court's offices within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all materials not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by Corte Plena at session N° 27-11 on August 22, 2011, article XXVI, and published in Boletín Judicial number 19 on January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, article LXXXI.

Por tanto:

The constitutional protection writ is granted. Sofía González Barquero, Roy Delgado Alpízar, Juan José Moya Argüello, and Lawrence Chacón Soto, in their respective capacities as mayor, coordinator of the Municipal Infrastructure Planning and Construction Process, coordinator of Cantonal Risk Prevention and Management, and coordinator of the Storm Drainage Activity, all of the Municipalidad de Alajuela, or whoever may hold those positions in their stead, are hereby ordered to coordinate as necessary, take the required measures, and issue the corresponding directives within the scope of their respective competencies, so that, within a maximum period of THREE MONTHS counted from the notification of this judgment, the problems reported by the moving party in the brief dated as received November 24, 2020, and in the email submitted on May 31, 2021, are resolved. The foregoing is issued with the warning that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, a prison sentence of three months to two years, or a fine of twenty to sixty days, shall be imposed on those who receive an order that they must comply with or cause to be complied with, issued in a recurso de amparo, and who fail to comply with or fail to cause compliance with such order, provided that the offense is not more severely punishable under another provision.

The Municipalidad de Alajuela is condemned to pay court costs (costas), damages, and losses (daños y perjuicios) arising from the acts underlying this declaration, which shall be assessed in enforcement-of-judgment proceedings (ejecución de sentencia) before the contentious-administrative jurisdiction. Justice Salazar Alvarado appends a note. Notify.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del catorce de enero de dos mil veintidos .

Recurso de amparo que se tramita en expediente número 21-023487-0007-CO, interpuesto por ALEJANDRA CHAVES CHAVES, cédula de identidad CED01, contra la MUNICIPALIDAD DE ALAJUELA.

Resultando:

  1. 1Por incorporado al expediente digital a las 21:58 horas del 17 de noviembre de 2021, la parte recurrente interpone recurso de amparo. Refiere que es dueña de una propiedad ubicada en Dirección01, en Desamparados de Alajuela, específicamente en la Urbanización El Valle, la cual está inscrita ante el Registro de la Propiedad con el número de finca 242586. Acota que, debido a la gran cantidad de residenciales construidos en la zona, el arroyo que pasa cerca de su casa ha incrementado de manera considerable, pues actualmente no solo discurren aguas pluviales, sino también aguas jabonosas y negras, que en época de verano se estancan, ocasionando malos olores y proliferación de mosquitos como el del dengue. Agrega que la problemática descrita también les afecta a las 42 viviendas ubicadas en esa urbanización. Explica que la cantidad de aguas que corren por el río ha causado gran erosión, incluso, se han caído 2 árboles que estaban al lado del cauce, llevándose consigo una importante porción de terreno de la parte final de la calle y de un lote correspondiente a una zona verde.Señala que, actualmente, el fundo de la zona verde no se puede utilizar, ya que no cuenta con algún sistema de seguridad que evite caídas al río. Asevera que el cauce del riachuelo ha incrementado de forma considerable, toda vez que la Municipalidad de Alajuela no intervino el alcantarillado de las aguas y, por el contrario, autorizó permisos de construcción, lo que ha incrementado la problemática descrita. Alega que en el lugar hay un nuevo proyecto llamado Hogares de Costa Rica, que posee una propiedad que colinda al este con la Urbanización El Valle y es utilizada como salida de aguas. Enuncia que el proyecto está en lo alto de la urbanización y del lote, donde se prevé construir una planta de tratamiento y una laguna de contención de aguas para las nuevas casas que se van a construir, la cual se ubicará a escasos 10 metros del área trasera de su propiedad. Afirma que el 24 de noviembre de 2020 planteó una denuncia ante la Municipalidad de Alajuela, por medio de la cual solicitó: “(…) que ese segundo árbol sea cortado y que ambos sean llevados y sacados del cañó (sic), porque de llover mucho se llenaría y se nos puede inundar las casas y lo segundo es que por favor sea entubado ese paso de agua que en apariencia es pluvial y jabonosa para evitar que siga lavando terreno aparte de lo ya mencionado de olores y plagas (…)”.Acusa que, ante la inacción del gobierno local respecto a solventar la situación descrita, en la actualidad han surgido nuevas dificultades. Expone que hace algunos meses, todos los días en horas de la tarde, el Condominio Aguas Claras vierte aguas negras o jabonosa al arroyo, las cuales generan fuertes olores que afectan a los habitantes de la Urbanización El Valle. Indica que a escasos 50 metros de la urbanización existe una naciente que está siendo afectada por la contaminación de esas aguas que no son trasladas como corresponde, afluente que está a cargo del Instituto Costarricense de Acueductos y Alcantarillados. Manifiesta que, con motivo de la erosión en el sitio, su propiedad ha sufrido gran afectación, pues está a tan solo 2 metros del cauce del riachuelo, situación que ha repercutido negativamente en el valor del fundo y en la opción de aseguramiento del mismo. Agrega que existe el riesgo de la estructura de su casa sufra daños considerables, ya que las raíces de los árboles están por debajo de la vivienda y existe la posibilidad de que parte de su casa sea arrastrada.Narra que la Comisión Nacional de Prevención de Riegos y Atención de Emergencias (CNE) emitió tres recomendaciones dirigidas a la municipalidad supramencionada; empero, no se les ha dado el seguimiento debido ni se ha solucionado el problema. Alude no comprender el motivo por el cual el gobierno local accionado no ha tomado en cuenta la necesidad del alcantarillado para encausar las aguas de los nuevos proyectos y con ello evitar la afectación de su propiedad. Estima lesionados sus derechos fundamentales. Solicita que se atienda la denuncia formulada el 24 de noviembre de 2020. Pide que se solucione el problema descrito.
  2. 2Mediante resolución de la Presidencia de la Sala de las 12:29 horas del 18 de noviembre de 2021, se dio curso al proceso y se requirió informen el alcalde, el encargado del Área de Prevención y Gestión de Riesgo Cantonal, así como el coordinador del Proceso de Planeamiento y Construcción de Infraestructura y el coordinador de Actividad de Alcantarillado Pluvial, todos de la Municipalidad de Alajuela, sobre los hechos alegados por la parte recurrente.
  3. 3Por escrito incorporado al expediente digital a las 16:34 horas del 25 de noviembre de 2021, informan bajo juramento Sofía González Barquero, Roy Delgado Alpízar, Juan José Moya Argüello y Lawrence Chacón Soto, por su orden alcaldesa, coordinador del Proceso de Planeamiento y Construcción de Infraestructura Municipal, promotor de Prevención y Gestión del Riesgo Cantonal y coordinador de la Actividad de Alcantarillado Pluvial, todos de la Municipalidad de Alajuela. Detallan que: “Mediante el oficio N° MA-A-6099-2021, el Lic. Luís Alonso Villalobos Molina, Asesor de Alcaldía, indicó que: "Ante gestión de la recurrente de seguimiento por parte de la Alcaidía -como Órgano Superior de la Administración Municipal- respecto a su trámite 25465-2020, propiamente en cuanto al extremo de dicho trámite referido a la solicitud de corta de un árbol que cayó en un caño contiguo a su vivienda y aduce podría inundar la casa, mediante el oficio No MA-A-2591-2021, de fecha 20 de mayo del 2021, la Alcaidía giró instrucciones a los Coordinadores de las dependencias de Alcantarillado Sanitario, Obras de Inversión Púbica y Gestión de Riesgo Cantonal, con el fin de que, con base en el antecedente inicial de atención institucional del trámite -oficio MA-PPCI-OGRC-0023-2021, de fecha 06 de enero del 2021-, se estableciera de inmediato la comunicación y coordinación del caso entre las dependencias y profesionales, con el fin de que - bajo las gestiones que resultaran pertinentes- de forma definitiva se produzca a la mayor brevedad la intervención en el sitio.Dicho oficio con la instrucción reseñada fue debidamente notificado el 20 de mayo del 2021, tanto a los titulares de las dependencias relacionadas como a la recurrente". Además que, "En respuesta a lo requerido por la Alcaidía en el oficio MA-A-2591-2021, mediante el oficio MA-AAP-0435-2021, de fecha 25 de mayo del 2021, la Actividad de Alcantarillado Pluvial reportó que dicha dependencia realizó labores de eliminación del árbol que se encontraba dentro del Canal y que generaba obstrucción de las aguas pluviales todo eso durante la primera semana de diciembre del 2020. Lo anterior, aclarando que Únicamente quedó sin extraer el tronco principal, pero el mismo no influye en el paso de agua por la altura a la que se encuentra y por su dimensión, peso y posición no poseen maquinaria o equipos para su extracción. Dicha respuesta del oficio citado le fue remitida por la Alcaidía a la recurrente a su dirección de correo el 31 de mayo del 2021 mediante el oficio N° MA-A-2732-2021, oficio por el cual mediante remisión de copia se solicitó a la dependencia de Alcantarillado Pluvial mantener seguimiento sobre el caso de interés.Por correo electrónico recibido el propio 31 de mayo del presente año, en respuesta a la comunicación oficial generada, la recurrente indicó que, al quedar el tronco en tierra el mismo sigue vivo y que hay ramas que crecerán, que seguiría la afectación y que solicita saber solución final el problema. Ante el correo recién referido de la recurrente, el suscrito reenvió ese mismo die dicha comunicación de la recurrente ellos titulares de las dependencias de Alcantarillado Pluvial y Gestión de Riesgo, indicando que bajo las instrucciones superiores les solicitaba tomar nota de todo la apuntado por la contribuyente para programar una nueva visita al sitio y valorar acciones en caso de ser procedentes”. Citan el memorial MA-ACC-4719-2021 del 24 de noviembre de 2021 suscrito por el coordinador de la Actividad de Control Constructivo. Indican que “Mediante el oficio N° MA-PPCI-PGRC-0752-2021 de fecha 23 de noviembre de 2021, suscrito por el Ing. Juan José Moya Argüello, Promotor, Prevención y Gestión del Riesgo Cantonal Planeamiento y Construcción Infraestructura manifestó en resumen que el tema fue debidamente atendido por conocido por varias dependencias, quienes comprobaron que el árbol cayó generando una posible emergencia en el sitio, sin embargo, existían también vehículos abandonados en las cercanías, tal y como se demuestra con la fotografía adjunta, y un taller invadiendo la zona de protección (…) Hecho que fue comprobado por el Subproceso de Gestión Ambiental, según conta en oficio MA-SGV-741~202O el cual indica que en una inspección realizada al sitio el árbol se ubica dentro de la zona de protección del cuerpo de agua, por lo que emitir criterio al respecto, se encontraba fuera de las competencias de dicha dependencia, esto de conformidad con lo que indica la Ley Forestal, por lo que recomienda la remisión del caso a la dirección del SINAC-MINAE en Alajuela para lo correspondiente.El 11 de noviembre de 2020, se recibe el oficio OA-1207 por parte del SINAC-MINAE de Alajuela, donde indican que realiza una visita al sitio en donde la especie del árbol que se encuentra es de Poró, el cual está inclinado al cauce de la Quebrada Targuá, ubicado sobre la ribera Izquierda de la quebrada, además indican que se observa una gran cantidad de desechos automotrices. los cuates amenazaban con deslizarse hacia el cauce de la quebrada. Por lo anterior, dicha instancia en [as recomendaciones y conclusiones indican que, al ubicarse un taller automotriz sobre los 10 m del área de protección de la Quebrada Targuá, actividad que impacta negativamente al suelo sin dejarlo recuperarse, se procederá con lo pertinente de acuerdo a la legislación vigente, y además de notificar con una prevención administrativa al propietario de la propiedad, y con ello, proceda de forma inmediata aplicar las medidas correctivas del caso y en caso omiso tramitar el informe ante el Ministerio público además de indicar que se dará seguimiento para un mejor proceder.El 19 de noviembre de 2020, se recibe el oficio MA-PSMCV-1045-2020 por parte del Proceso de Seguridad Municipal y Control Vial, el cual indica que se realiza una visita al sitio donde se conversa con los propietarios de los vehículos concediéndoles un plazo de 48 horas a partir del 6 de noviembre en curso, luego de eso en una visita el 19 de noviembre se logró constatar que ya los vehículos abandonados, fueron retirados de la vía pública por los propietarios, atendiéndose en parte la situación descrita respecto a los vehículos ubicados en vía pública. El 20 de noviembre de 2020, se recibe el informe CNE-UIAR-0986-2020 por parte de la Unidad de Investigación y Análisis del Riesgo de la Comisión Nacional de Emergencias, informe que nace a raíz de una solicitud presentada por la señora Alejandra Chaves, se indica que al momento de la inspección se observa aún el árbol producto, mismo que cae cerca del cuerpo de agua posiblemente debido a la erosión de las márgenes de este cuerpo de agua, además indican que la erosión del canal ha puesto en riesgo directo una estructura que está siendo utilizada aparentemente como un taller, donde también se observa basura, y que este se encuentra a menos de 10 m del cauce.Ante ello, en sus conclusiones indican que el árbol en el cauce representa un riesgo, ya que podría causar un represamiento de no extraerse, además que la falta de protección en las márgenes del cauce y la gran cantidad de agua recogida de la parte alta, han incrementado la fuerza erosiva y los daños, donde de no intervenirse el cauce y realizar una obra de protección que evite la erosión del canal, se va a seguir socavando la ladera y en el futuro poner en riesgo la vivienda el taller. Finalmente, en sus recomendaciones la CNE indica que la municipalidad debe en corto plazo remover el árbol caído para evitar represamientos del cauce, además de valorar la posibilidad de realizar una obra que proteja las márgenes, y con ello, se evite la erosión, como la implementación de lagunas de retención para disminuir la vulnerabilidad desbordamientos, hecho que fue realizado por la Actividad de Alcantarillado Pluvial, según se indicará”.Transcriben el contenido del oficio MA-AAP-0954-202 del 23 de noviembre de 2021 suscrito por el coordinador de la Actividad de Alcantarillado Pluvial y el director del Proceso de Planeamiento y Construcción de Infraestructura Municipal. Consideran que el gobierno municipal ha sido diligente y ha efectuado las labores propias de su competencia. Refieren que se constató que el proyecto “Condominio Azul” cumple los parámetros establecidos por la municipalidad. Expresan que se han atendido todas las diligencias formuladas por la recurrente. Afirman que “no se cuenta, a nivel de registros municipal, con denuncias por la afectación a 42 viviendas en el sector, siendo que la amparada tampoco lo demuestra y se limita a manifestarlo, sin aportar las pruebas que lo comprueben”.
  4. 4En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I. SOBRE LA EXCEPCIÓN DEL ARTÍCULO 41 DE LA CONSTITUCIÓN POLÍTICA

Uno de los aspectos señalados podría configurar una lesión al derecho a una justicia administrativa pronta y cumplida. Al respecto, debe aclararse que, a partir del voto número 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa — con algunas excepciones — aquellos asuntos en los que se discute si la autoridad pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, a fin de resolver por acto final un procedimiento administrativo — incoado de oficio o a instancia de parte— o conocer de los recursos administrativos procedentes. Precisamente, en este recurso se plantea un supuesto de excepción pues el sub examine está relacionado con la interposición de denuncias por la ubicación de árboles que generan riesgo de inundaciones en caso de lluvias, así como por la erosión que sufre una propiedad, debido a un caño. En virtud de lo anterior, la Sala entrará a resolver el recurso.

II. OBJETO DEL RECURSO

La parte recurrente indica que posee una vivienda en la urbanización El Valle en Desamparados de Alajuela. Acota que, debido a la gran cantidad de residenciales construidos en la zona, el arroyo que pasa cerca de su casa se ha incrementado de manera considerable, pues actualmente no solo discurren aguas pluviales, sino también jabonosas y negras, las cuales en época de verano se estancan y ocasionan malos olores y proliferación de mosquitos. Explica que la cantidad de agua que corre por el río ha causado gran erosión, incluso, se han caído 2 árboles que estaban al lado del cauce. Afirma que el 24 de noviembre de 2020 planteó una denuncia ante la Municipalidad de Alajuela, por medio de la cual solicitó: “(…) que ese segundo árbol sea cortado y que ambos sean llevados y sacados del cañó (sic), porque de llover mucho se llenaría y se nos puede inundar las casas y lo segundo es que por favor sea entubado ese paso de agua que en apariencia es pluvial y jabonosa para evitar que siga lavando terreno aparte de lo ya mencionado de olores y plagas (…)”.

Acusa que, ante la inacción del gobierno local para solventar la situación descrita, en la actualidad han surgido nuevas dificultades. Narra que, en noviembre de 2020, la CNE emitió tres recomendaciones dirigidas a la municipalidad supramencionada referente a la problemática acusada; empero, no se les ha dado el seguimiento debido ni se ha solucionado el problema.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

  • a)La accionante es dueña de una vivienda ubicada en la urbanización El Valle en Desamparados de Alajuela. (Hecho incontrovertido).
  • b)El 17 de noviembre de 2020 ‑con fecha de recibido 24 de noviembre de 2020‑, la amparada planteó una gestión ante la Municipalidad de Alajuela a la que se le asignó el número de trámite 25465-2020, en la que indicó:

“Me dirijo a ustedes a través de este medio para buscar solución a ciertas dificultades que se han presentado a un lado de mi casa. Les relato un poco de lo sucedido.

Nuestra casa tenía un distanciamiento de 10 metros lineales desde el caño hasta la casa, cuyo lote corresponde a zona verde de la urbanización. A través de los años y por las residenciales construidas en los últimos años hacia el noreste de la propiedad la cantidad de aguas que pasan por ese cañó (sic) se ha incrementado, Aguas que cabe mencionar se estancan en verano y provocando malos olores y plagas como Dengue, y esto porque mis sobrinos ya lo padecieron. Este problema no solo me atañe a mí y mi familia si no (sic) también a todos los que vivimos en esa localidad.

En los últimos años esas cantidades de agua han provocado que el terreno este falseado y el cañó (sic) este muchísimo más grande al punto de que ahora son 6 mts lineales lo que mide el terreno.

Aparte siempre han existido 2 árboles bastante grandes cuyas raíces han logrado mucha profundidad, uno de ellos se cayó el 2 de noviembre de este año sobre el cauce del cañó (sic) y se llevó con sigo mucha tierra y tres carros y parte del final de la calle. Y el otro árbol cuyas raíces afectan mi propiedad, ya hizo un retumbo y está a punto de caer, si esto sucede va afectar significativamente mi casa por el tema de raíces.

Necesitamos 2 cosas la primera es que ese segundo árbol sea cortado y que ambos sean llevados y sacados del cañó (sic), porque de llover mucho se llenaría y se nos puede inundar las casas y lo segundo es que por favor sea entubado ese paso de agua que en apariencia es pluvial y jabonosa para evitar que siga lavando terreno aparte de lo ya mencionado de olores y plagas.

Cualquier duda al respecto me puede escribir al 86709872 ml nombre es Alejandra Chaves Ch.

Agradezco el apoyo que nos pueda brindar y quedo atenta a las posibles soluciones y al plazo estimado de atención a la presente”. (Ver prueba documental).

  • c)El 19 de noviembre de 2020, la CNE emitió el informe técnico CNE-UIAR-INF-0986-2020 “Valoración de riesgo de inundación e inestabilidad de terreno por colapso de árbol en cauce”, en el que se indicó:

“I. Información general Por solicitud de la interesada el día 12 de noviembre se realizó la evaluación visual de nesgo en Desamparados de Alajuela, por la erosión de un cauce que indujo el colapso de un árbol (…)

V. Conclusiones

A. Aparentemente la erosión del cauce socavo (sic) las raíces del árbol y se dio el colapso.

B. Según lo que se observó en el campo y analizando el mapa y las fotos aéreas este cauce no es natural y es un alcantarillado que recoge las aguas de las viviendas de la parte alta de la cuenca.

C. La falta de protección en las márgenes del cauce y la gran cantidad de agua recogida de la parte alta han incrementado la fuerza erosiva y los daños.

D. El árbol en el cauce representa un riesgo ya que podría causar un represamiento.

E. De no intervenir el cauce y realizar una obra de protección que evite la erosión el canal se va a seguir socavando la ladera y en un futuro poner en riesgo la vivienda y el taller.

VI. Recomendaciones

Nombre01. La Municipalidad debe en un corto plazo remover el árbol caído para evitar represamientos B. También debe valorar la posibilidad de realizar una obra que proteja las márgenes para que evite que se siga dando erosión e implementar lagunas de retención para disminuir la vulnerabilidad de desbordamientos.

C. Cualquier obra que se debe de realizar con la supervisión de un profesional capacitado y contar con los estudios correspondientes (…)” (la negrita fue añadida).

Tal informe fue notificado a la corporación municipal recurrida el 20 de noviembre de 2020. (Ver prueba documental e informe rendido bajo juramento por las autoridades accionadas).

  • d)El 6 de enero de 2021, funcionarios del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela remitieron el oficio MA-PPCI-PGRC-0023-2021 al coordinador de la Actividad de Alcantarillado Pluvial, por medio del que externaron que:

“(…) se remite para su atención el Trámite #25465-2020 como copia de los oficios MA-PSMCV-1045-2020, MA-SGA-741-2020, CNE-UIAR-INF-0986-2020 y OA-1207, los cuales corresponden a una situación ya remitida a sus dependencias desde el pasado 03 de noviembre del 2020 a través del oficio MA-PPCI-PGRC-0704-2020.

Debido a lo anterior, se realizó una nueva inspección al sitio, encontrándose aún la problemática existente en el sitio, por lo que se le solicita interponer sus buenos oficios en la atención de lo suscitado, y con ello brindarle una respuesta a los afectado (sic), debido a que actualmente el sitio aqueja la necesidad de intervención PRIORITARIA y URGENTE. Cabe resaltar que nos encontramos anuentes de colaborar en la gestión de lo suscitado ya sea a través de la supervisión técnica de las obras o en su defecto en la gestión de la contratación que corresponda, siempre y cuando se cuete (sic) con los recursos necesarios”. (Ver prueba documental).

  • e)El 20 de mayo de 2021, un funcionario de la Municipalidad de Alajuela remitió el memorial MA-A-2591-2021 a Lawrence Chacón Soto, Kasey Palma Chavarría y Juan José Moya Argüello, por su orden, coordinador de la Actividad de Alcantarillado Pluvial, coordinadora del Subproceso de Obras de Inversión Pública y servidor de Prevención y Gestión de Riesgo Cantonal. En tal oficio se solicitó, en relación al trámite n.° 25465-2020 y los términos del oficio MA-PPCI-PGRC-00232021: “Establecer de inmediato la comunicación y coordinación del caso entre las dependencias y profesionales, con el fin de que -bajo las gestiones que resulten pertinentes- de forma definitiva se produzca a la mayor brevedad la intervención que corresponda en el sitio”. (Ver prueba documental).
  • f)El 25 de mayo de 2021, el coordinador del Alcantarillado Pluvial del gobierno local recurrido emitió el oficio MA-AAP-0435-2021 dirigido al alcalde de Alajuela referente a la denuncia interpuesta por la tutelada, en el que indicó que:

“esta dependencia realizó labores de eliminación del árbol que se encontraba dentro del canal y generaba obstrucción de las aguas pluviales, todo ello durante la primera semana de diciembre de 2020.

Debe aclararse que únicamente quedo (sic) sin extraer el tronco principal, pero el mismo no influye en el paso del agua por la altura a la que se encuentra y por su dimensión, peso y posición no poseemos maquinaria o equipos para su extracción”. (Ver prueba documental).

  • g)El 28 de mayo de 2021, un asesor de la Municipalidad de Alajuela remitió el oficio MA-A-2732-2021 a la amparada, por medio del que indicó que, en respuesta a la denuncia n.° 25465-2020, adjunta el memorial MA-AAP-0435-2021 “el cual contiene un informe respecto a las labores efectuadas y situaciones de manejo de aguas. A su vez, por copia del presente se solicita a dicha dependencia mantener un seguimiento sobre el caso de interés”. (Ver prueba documental).
  • h)El 31 de mayo de 2021, la corporación municipal recurrido notificó a la amparada, vía correo electrónico, el oficio MA-A-2732-2021 referente a la respuesta a la denuncia n.° 25465-2020. Además, se le indicó que “se está solicitando a la dependencia respectiva mantener un seguimiento a la situación”. (Ver prueba documental).
  • i)El 31 de mayo de 2021, la tutelada envió un correo electrónico a un funcionario del gobierno local accionado, por medio del que señaló:

“(…) En efecto ellos hicieron parte de la extracción pero al quedar el tronco en tierra el mismo sigue vivo, y esta (sic) dando nuevamente ramas, y al estar en una posición horizontal hay ramas que crecerán también hacia bajo.

Aparte mi queja y la inspección de la CNE no es solo por eso. Si no por el otro alborí (sic) que esta (sic) a 10mts aproximadamente que está afectando mi propiedad por las raíces las cuales han hecho hueco en mi casa y adicionalmente porque esas son agua (sic) pluviales y otro tipo que no están entubadas y con el transcurso de los años los (sic) que era un caño sin importancia hoy tiene dimensiones mayores por no estar debidamente entubado y al estarse usando de manera indiscriminada por propiedades y condominios más arriba de nuestras casas.

Yo no necesito saber lo que ya se (sic), me refiero a la hoja 2 del pdf adjunto. Si no la solución final al problema.

Nuevamente indico antes de zona verde a la par mi propiedad era N cantidad de metros ahora hay 4x7 (…)”. (Ver prueba documental).

  • j)El 31 de mayo de 2021, un funcionario de la Municipalidad de Alajuela dirigió un correo electrónico a “Lawrence Chacón Soto; Juan José Moya Argüello”, mediante el que manifestó “En relación con la atención y seguimiento a la denuncia de la señora Alejandra Cháves Cháves (trámite inicial N° 25465-2020), con las instrucciones superiores del caso les solicito tomar nota de lo apuntado por la contribuyente en el correo adjunto, todo con el fin de que se programe una nueva visita e inspección al sitio y valorar posible acciones en caso de ser procedentes”. (Ver prueba documental).
  • k)El 22 de noviembre de 2021, las autoridades recurridas fueron notificadas de la resolución de curso de este amparo. (Ver actas de notificación).
  • l)El 23 de noviembre de 2021, un funcionario de Prevención y Gestión del riesgo Cantonal del gobierno local accionado emitió el oficio MA-PPCI-PGRC-0752-2021, por medio del que señaló:

“(…) 1. El 02 de noviembre de 2020, se generan cuatro incidentes de emergencias del Sistema 9-1-1 (2020-11-02-00432, 2020-11-02-00455, 2020-11-02-00726 y 2020-11-03-00396), los cuales indican la caída de un árbol de gran tamaño sobre una acequia que pasa al final de la Dirección02, en Desamparados, específicamente 300m noroeste y 200 al este del restaurante La Carreta (…)

2. El 03 de noviembre de 2020, se realiza una inspección al sitio donde se valida lo suscitado y se ubica un árbol de gran tamaño que peligra con la obstrucción del cuerpo de agua, además de presentarse una importante caída de material producto de la saturación de los suelos de los últimos días.

3. Debido a lo anterior, se genera el oficio MA-PPCI-PGRC-0704-2020 el cual se remite a la Actividad de Alcantarillado Pluvial, donde amparado en las funciones propias de dicha dependencia como lo son la "Limpieza de cauces de cuerpos de agua", se solicita interponer los buenos oficios en lo suscitado, debido a que el sitio se aquejaba la necesidad de intervención urgente, pues de no atenderlo ponía en riesgo la vida de las personas que residen en la zona.

Del mismo modo se copia de dicho oficio al Proceso de Seguridad Municipal y Control Vial a fin de que se intervinieran unos vehículos abandonados que se encontraban en la vía pública además se remitió copia de este al Subproceso de Gestión Ambiental y al Ministerio de Ambiente y Energía para lo correspondiente.

4. El 05 de noviembre de 2020, se recibe el oficio MA-SGV-741-2020 por parte del Subproceso de Gestión Ambiental el cual indica que en una inspección realizada al sitio el árbol se ubica dentro de la zona de protección del cuerpo de agua por lo que emitir criterio al respecto se encontraba fuera de las competencias de dicha dependencia esto de conformidad con lo que indica la Ley Forestal, por lo que recomienda la remisión del caso a la dirección del SINAC-MINAE en Alajuela para lo correspondiente.

5. El 11 de noviembre de 2020, se recibe el oficio OA-1207 por parte del SINAC-MINAE de Alajuela, donde indican que realiza una visita al sitio en donde la especie del árbol que se encuentra es de Poró el cual esta inclinado al cauce de la Quebrada Targuá, ubicado sobre la ribera izquierda de la quebrada, además indican que se observa una gran cantidad de desechos automotrices, los cuales amenazaban con deslizarse hacia el cauce de la quebrada.

Por lo anterior, dicha instancia en las recomendaciones y conclusiones indican que, al ubicarse un taller automotriz sobre los 10 m del área de protección de la Quebrada Targuá, actividad que impacta negativamente al suelo sin dejarlo recuperarse, se procederá con lo pertinente de acuerdo a la legislación vigente y además de notificar con una prevención administrativa al propietario de la propiedad, y con ello, proceda de forma inmediata aplicar las medidas correctivas del caso y en caso omiso tramitar el informe ante el Ministerio público además de indicar que se dará seguimiento para un mejor proceder.

6. El 19 de noviembre de 2020, se recibe el oficio MA-PSMCV-1045-2020 por parte del Proceso de Seguridad Municipal y Control Vial, el cual indica que se realiza una visita al sitio donde se conversa con los propietarios de los vehículos concediéndoles un plazo de 48 horas a partir del 6 de noviembre en curso luego de eso en una visita el 19 de noviembre se logró constatar que ya los vehículos abandonados, fueron retirados de la vía pública por los propietarios atendiéndose en parte la situación descrita respecto a los vehículos ubicados en vía pública.

7. El 20 de noviembre de 2020, se recibe el informe CNE-UIAR-U986-2020 por parte de la Unidad de Investigación y Análisis del Riesgo de la Comisión Nacional de Emergencias, informe que nace a raíz de una solicitud presentada por la señora Alejandra Chaves se indica que al momento de la inspección se observa aún el árbol producto, mismo que cae cerca del cuerpo de agua posiblemente debido a la erosión de las márgenes de este cuerpo de agua, además indican que la erosión del canal ha puesto en riesgo directo una estructura que está siendo utilizada aparentemente como un taller, donde también se observa basura, y que este se encuentra a menos de 10 m del cauce.

Ante ello, en sus conclusiones indican que el árbol en el cauce representa un riesgo ya que podría causar un represamiento de no extraerse, además que la falta de protección en las márgenes del cauce y la gran cantidad de agua recogida de la parte alta, han incrementado la fuerza erosiva y los daños donde de no intervenirse el cauce y realizar una obra de protección que evite la erosión del canal se va a seguir socavando la ladera y en el futuro poner en riesgo la vivienda el taller.

Finalmente, en sus recomendaciones la CNE indica que la municipalidad debe en corto plazo remover el árbol caído para evitar represamientos del cauce, además de valorar la posibilidad de realizar una obra que proteja las márgenes, y con ello, se evite la erosión, como la implementación de lagunas de retención para disminuir la vulnerabilidad desbordamientos.

8. El 17 de diciembre de 2020, se recibe el trámite N°25465-2020 el cual es remitido por la señora Alejandra Chaves en donde en su planteamiento expone la necesidad de intervención del cauce a través de la extracción de los árboles caídos como un peligro en la salida de aguas pluviales cercanas a su vivienda, debido al peligro que este representa de cara al invierno del próximo año.

Debido a lo anterior, y en vista de la necesidad de inversión del sitio el 06 de enero de 2021 se remite ante la Actividad de Alcantarillado Pluvial el oficio MA-PPCI-PGRC-0023-2021 en el cual se remite copia de los informes citados anteriormente, además de indicarse que el problema persiste debiéndose atender de manera prioritaria y urgente lo suscitado además de quedar atentos ante cualquier requerimiento para el abordaje de ello, pero en su momento no se (sic) tal necesidad, con esto se atiende lo solicitado por la señora chaves en su gestión.

9. El 09 de marzo de 2021, a través de un correo electrónico la señora Chaves inconforme con la gestión realizada indica que se reunió con el licenciado Alonso Villalobos de la Alcaldía, el cual le indico (sic) colaborarle en la gestión de lo suscitado.

10. El 20 de mayo de 2021, con el oficio MA-A-2591-2021. el licenciado Alonso Villalobos, asesor de su despacho remite para lo correspondiente copia del oficio MA-PPCI-PGRC-0023-2021 emitido por este Proceso como copia del trámite N° 25465-2020 de la señora Chaves, ante el Subproceso de Obras de Inversión Pública y la Actividad de Alcantarillado Pluvial para que de forma definitiva se produzca a la mayor brevedad la intervención que corresponda en el sitio.

11. El 26 de mayo de 2021 mediante el oficio MA-AAP-0435-2021 la Actividad de Alcantarillado Pluvial, indica ÚNICAMENTE a la Alcaldía que en las primeras semanas del mes de diciembre atiende lo suscitado y corta gran parte del árbol caído, quedando en el sitio únicamente el tronco, eliminándose las obstrucciones y ramas caídas de este, pero peligra el tronco con caerse si se erosiona la margen del cauce, debido a su gran tamaño, indican a su vez también que, debido al tamaño del tronco y sus dimensiones, peso y posición no fue posible extraerlo con equipos o maquinaria municipal (…)

12. El 31 de mayo de 2021, mediante el oficio MA-A-2732-2021 la Alcaldía Municipal notifica a la señora Chaves sobre lo suscitado y remite copia del oficio de la Actividad de Alcantarillado Pluvial, sin embargo, la señora chaves mediante correo electrónico indica que efectivamente la municipalidad realizó la extracción, pero al quedar el tronco la tierra el mismo sigue vivo y está dando nuevamente ramas y que al estar en una posición horizontal, existen hay ramas que crecen también hacia abajo.

Además, tal y como se mencionó en el punto 8 del presente informe, parte de la queja de la señora Nombre02 se refería a una problemática con aguas pluviales que se encuentran cerca de su casa, mismas que en apariencia no están encausadas y que, con el transcurso de los años, hoy el cauce tiene dimensiones mayores por no estar debidamente canalizado, por lo que refiere sobre la necesidad de intervención de dicha problemática adicional.

Finalmente, es importante resaltar que la contratación de una maquinaria a través de la Comisión Nacional de Emergencias únicamente para la extracción de dicho árbol resultaría inviable, en primer lugar, por el sitio donde se ubica, y segundo debido a que una empresa que posea maquinaria pesada (Pala Excavadora) no atendería una tarea que puede desarrollarse en menos de dos horas ya que logísticamente el traslado y el emplazamiento de esta maquinaria es complejo.

Técnicamente resulta inviable el solicitar dicha maquinaría, lo que se Sugiere es la extracción de dicho árbol a través de una contratación especial para la corta este en secciones más pequeñas y éstas a su vez pueden ser extraída de manera eficiente.

Por tanto, este Proceso ha gestionado todas las acciones pertinentes para la atención de la problemática suscitada en la zona pues como se ha indicado en documentos anteriores permanecemos a la disposición de colaborar con el Departamento de Alcantarillado Pluvial en las gestiones que se requieran para la atención integral de la zona, ya sea a través de la búsqueda de recursos para la atención adecuada, como de cualquier requerimiento adicional que sea necesario para una intervención definitiva”. (Ver prueba documental).

  • m)El 23 de noviembre de 2021, el coordinador del Alcantarillado Pluvial y el director de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela emitieron el oficio MA-AAP-0954-2021, mediante el que externaron que:

“(…) 3. Debido al aumento en las condiciones de las precipitaciones, todos los cauces han sufrido cambios importantes en su comportamiento, esto provocado según expertos por el cambio climático el cual ha generado que se produzcan lluvias de mayor intensidad y duración, siendo un factor totalmente exógeno a la Municipalidad de Alajuela.

Sin embargo, es necesario señalar que la Municipalidad de Alajuela ha sido previsoria en el tema de manejo de las aguas pluviales para proyectos inmobiliarios o desarrollos constructivos en general y desde hace más de 10 años se tiene como requisito para la aprobación del Visto Bueno de descarga de aguas pluviales para todo proyecto de construcción de gran envergadura el establecimiento de un plan de manejo de aguas pluviales, los cuales en su mayoría (casi su totalidad) establecen la construcción de sistemas de retardo para las aguas pluviales (…)

Siendo el caso, la zona que la recurrente describe como "el fundo de la zona verde", corresponde a la zona de protección de la quebrada Targuá, por lo que dentro de la misma no es factible realizar ningún tipo de construcción, según lo establece la norma.

6. Que, en la colindancia noreste de la urbanización El Valle, se ubica un terreno por medio del cual se aprobó la descarga de aguas pluviales del proyecto "Condominio Azul", mismo que cumple con los lineamientos establecidos por la Municipalidad de Alajuela, entre ellos el establecimiento de un plan de manejo de aguas pluviales, en este caso la construcción de un tanque de retención de aguas con capacidad para 415,90m3, tal y como lo apunta la señora Chaves Chaves en su Recurso de Amparo.

7. Con relación a la solicitud que ha realizado la recurrente para que se "entube ese paso de aguas", es necesario mencionar que los cauces naturales por sus condiciones no deben ser entubado (salvo casos especiales) esto debido a que ese proceso (de entubar), elimina de la flora y fauna que puedan proliferar en la zona de protección la cual fue creada principalmente para la preservación de la naturaleza (…)

10. Sobre la erosión que pudiera tener la propiedad de la recurrente. el hecho podría obedecer a factores naturales como lo son el cambio del curso de la quebrada (cuyo origen podría ser algún evento sísmico, la sedimentación del cauce en algún punto u otros) o si existe una invasión a la zona de protección, en cuyo caso correspondería a otras instituciones determinar la condición en que se encuentra la propiedad y las construcciones de la recurrente.

11. En cuanto a la afectación por las raíces de los árboles, resulta improbable conocer con certeza cual (sic) o cuales (sic) los árboles poseen raíces que alcancen la propiedad de la señora Chaves Chaves, por lo que para tomar alguna acción al respecto se tendrían que talar todos los árboles ubicados en la zona de protección de la quebrada y aledaños al inmueble afecta, situación que afectaría de manera contraria la naturaleza de las zonas de protección” (la negrita fue añadida). (Ver prueba documental).

  • n)El 24 de noviembre de 2021, el coordinador de la Actividad de Control Constructivo de la Municipalidad de Alajuela emitió el oficio MA-ACC-4710-2021, por medio del que detalló que:

“(…) 3. Se desliga que la propiedad de la denunciante corresponde a la finca matrícula 2-242586-ooo plano catastrado A-842537-1989 colindante con la zona de Protección de la Quebrada Targuá, de ahí que la Sra. Chaves referencie como "caño" el margen de la quebrada este cuenta con un porcentaje de terreno bajo finca matrícula 2-176431-coo plano catastrado a nombre de la Asoc. Desarrollo Integral Bella Vista Alajuela.

4. Con respecto a la problemática denunciada por la Sra. Alejandra Chaves consideramos pertinente coordinar con los departamentos de Alcantarillado Pluvial y la oficina de Gestión y Prevención de Riesgo Municipal a fin de dar seguimiento a los trabajos realizados en sitio, por tratarse de competencias propias de ellos.

Tomando en consideración los argumentos expuestos de los desarrollos habitacionales vecinos; los mismos han cumplido a cabalidad con la normativa vigente toda la documentación se encuentra incorporada en los diferentes expedientes administrativos.

Ahora bien, ya serán los departamentos técnicos en la materia que brinden la información y la solución a la problemática de descarga de agua no solo pluvial jabonosa como también de aguas negras, como se indica en el escrito presentado por la Sra. Chaves Chaves (…)”. (Ver prueba documental).

IV. SOBRE EL CASO CONCRETO

En el sub lite, la parte recurrente indica que posee una vivienda en la urbanización El Valle en Desamparados de Alajuela. Acota que, debido a la gran cantidad de residenciales construidos en la zona, el arroyo que pasa cerca de su casa se ha incrementado de manera considerable, pues actualmente no solo discurren aguas pluviales, sino también jabonosas y negras, las cuales en época de verano se estancan y ocasionan malos olores y proliferación de mosquitos. Explica que la cantidad de agua que corre por el río ha causado gran erosión, incluso, se han caído 2 árboles que estaban al lado del cauce. Afirma que el 24 de noviembre de 2020 planteó una denuncia ante la Municipalidad de Alajuela, por medio de la cual solicitó: “(…) que ese segundo árbol sea cortado y que ambos sean llevados y sacados del cañó (sic), porque de llover mucho se llenaría y se nos puede inundar las casas y lo segundo es que por favor sea entubado ese paso de agua que en apariencia es pluvial y jabonosa para evitar que siga lavando terreno aparte de lo ya mencionado de olores y plagas (…)”.

Acusa que, ante la inacción del gobierno local para solventar la situación descrita, en la actualidad han surgido nuevas dificultades. Narra que, en noviembre de 2020, la CNE emitió tres recomendaciones dirigidas a la municipalidad supramencionada referente a la problemática acusada; empero, no se les ha dado el seguimiento debido ni se ha solucionado el problema.

La Sala verifica que la accionante es dueña de una vivienda ubicada en la urbanización El Valle en Desamparados de Alajuela. Asimismo, se acredita que, el 17 de noviembre de 2020 ‑con fecha de recibido 24 de noviembre de 2020‑, la amparada planteó una gestión ante la Municipalidad de Alajuela a la que se le asignó el número de trámite 25465-2020, en la que indicó: “Me dirijo a ustedes a través de este medio para buscar solución a ciertas dificultades que se han presentado a un lado de mi casa. Les relato un poco de lo sucedido. Nuestra casa tenía un distanciamiento de 10 metros lineales desde el caño hasta la casa, cuyo lote corresponde a zona verde de la urbanización. A través de los años y por las residenciales construidas en los últimos años hacia el noreste de la propiedad la cantidad de aguas que pasan por ese cañó (sic) se ha incrementado, Aguas que cabe mencionar se estancan en verano y provocando malos olores y plagas como Dengue, y esto porque mis sobrinos ya lo padecieron.

Este problema no solo me atañe a mí y mi familia si no (sic) también a todos los que vivimos en esa localidad. En los últimos años esas cantidades de agua han provocado que el terreno este falseado y el cañó (sic) este muchísimo más grande al punto de que ahora son 6 mts lineales lo que mide el terreno. Aparte siempre han existido 2 árboles bastante grandes cuyas raíces han logrado mucha profundidad, uno de ellos se cayó el 2 de noviembre de este año sobre el cauce del cañó (sic) y se llevó con sigo mucha tierra y tres carros y parte del final de la calle. Y el otro árbol cuyas raíces afectan mi propiedad, ya hizo un retumbo y está a punto de caer, si esto sucede va afectar significativamente mi casa por el tema de raíces. Necesitamos 2 cosas la primera es que ese segundo árbol sea cortado y que ambos sean llevados y sacados del cañó (sic), porque de llover mucho se llenaría y se nos puede inundar las casas y lo segundo es que por favor sea entubado ese paso de agua que en apariencia es pluvial y jabonosa para evitar que siga lavando terreno aparte de lo ya mencionado de olores y plagas.

Cualquier duda al respecto me puede escribir al 86709872 ml nombre es Alejandra Chaves Ch. Agradezco el apoyo que nos pueda brindar y quedo atenta a las posibles soluciones y al plazo estimado de atención a la presente” (el resaltado fue agregado).

Este Tribunal tiene por demostrado que, el 19 de noviembre de 2020, la CNE emitió el informe técnico CNE-UIAR-INF-0986-2020 “Valoración de riesgo de inundación e inestabilidad de terreno por colapso de árbol en cauce”, en el que se indicó: “I. Información general Por solicitud de la interesada el día 12 de noviembre se realizó la evaluación visual de nesgo en Desamparados de Alajuela, por la erosión de un cauce que indujo el colapso de un árbol (…) V. Conclusiones A. Aparentemente la erosión del cauce socavo (sic) las raíces del árbol y se dio el colapso. B. Según lo que se observó en el campo y analizando el mapa y las fotos aéreas este cauce no es natural y es un alcantarillado que recoge las aguas de las viviendas de la parte alta de la cuenca. C. La falta de protección en las márgenes del cauce y la gran cantidad de agua recogida de la parte alta han incrementado la fuerza erosiva y los daños.

D. El árbol en el cauce representa un riesgo ya que podría causar un represamiento. E. De no intervenir el cauce y realizar una obra de protección que evite la erosión el canal se va a seguir socavando la ladera y en un futuro poner en riesgo la vivienda y el taller. VI. Recomendaciones A. La Municipalidad debe en un corto plazo remover el árbol caído para evitar represamientos B. También debe valorar la posibilidad de realizar una obra que proteja las márgenes para que evite que se siga dando erosión e implementar lagunas de retención para disminuir la vulnerabilidad de desbordamientos. C. Cualquier obra que se debe de realizar con la supervisión de un profesional capacitado y contar con los estudios correspondientes (…)” (la negrita fue añadida). Tal informe fue notificado a la corporación municipal recurrida el 20 de noviembre de 2020.

De igual forma, se comprueba que, el 6 de enero de 2021, funcionarios del Proceso de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela remitieron el oficio MA-PPCI-PGRC-0023-2021 al coordinador de la Actividad de Alcantarillado Pluvial, por medio del que externaron que: “(…) se remite para su atención el Trámite #25465-2020 como copia de los oficios MA-PSMCV-1045-2020, MA-SGA-741-2020, CNE-UIAR-INF-0986-2020 y OA-1207, los cuales corresponden a una situación ya remitida a sus dependencias desde el pasado 03 de noviembre del 2020 a través del oficio MA-PPCI-PGRC-0704-2020. Debido a lo anterior, se realizó una nueva inspección al sitio, encontrándose aún la problemática existente en el sitio, por lo que se le solicita interponer sus buenos oficios en la atención de lo suscitado, y con ello brindarle una respuesta a los afectado (sic), debido a que actualmente el sitio aqueja la necesidad de intervención PRIORITARIA y URGENTE. Cabe resaltar que nos encontramos anuentes de colaborar en la gestión de lo suscitado ya sea a través de la supervisión técnica de las obras o en su defecto en la gestión de la contratación que corresponda, siempre y cuando se cuete (sic) con los recursos necesarios” (el destacado fue suplido).

Por su parte, el 20 de mayo de 2021, un funcionario de la Municipalidad de Alajuela remitió el memorial MA-A-2591-2021 a Lawrence Chacón Soto, Kasey Palma Chavarría y Juan José Moya Argüello, por su orden, coordinador de la Actividad de Alcantarillado Pluvial, coordinadora del Subproceso de Obras de Inversión Pública y servidor de Prevención y Gestión de Riesgo Cantonal. En tal oficio se solicitó, en relación al trámite n.° 25465-2020 y los términos del oficio MA-PPCI-PGRC-00232021: “Establecer de inmediato la comunicación y coordinación del caso entre las dependencias y profesionales, con el fin de que -bajo las gestiones que resulten pertinentes- de forma definitiva se produzca a la mayor brevedad la intervención que corresponda en el sitio”. Mientras que, el 25 de mayo de 2021, el coordinador del Alcantarillado Pluvial del gobierno local recurrido emitió el oficio MA-AAP-0435-2021 dirigido al alcalde de Alajuela referente a la denuncia interpuesta por la tutelada, en el que indicó que: “esta dependencia realizó labores de eliminación del árbol que se encontraba dentro del canal y generaba obstrucción de las aguas pluviales, todo ello durante la primera semana de diciembre de 2020.

Debe aclararse que únicamente quedo (sic) sin extraer el tronco principal, pero el mismo no influye en el paso del agua por la altura a la que se encuentra y por su dimensión, peso y posición no poseemos maquinaria o equipos para su extracción” (el destacado fue agregado).

Esta Cámara aprecia que, el 28 de mayo de 2021, un asesor de la Municipalidad de Alajuela remitió el oficio MA-A-2732-2021 a la amparada, por medio del que indicó que, en respuesta a la denuncia n.° 25465-2020, adjunta el memorial MA-AAP-0435-2021 “el cual contiene un informe respecto a las labores efectuadas y situaciones de manejo de aguas. A su vez, por copia del presente se solicita a dicha dependencia mantener un seguimiento sobre el caso de interés”. Así, el 31 de mayo de 2021, la corporación municipal recurrido notificó a la amparada, vía correo electrónico, el oficio MA-A-2732-2021 referente a la respuesta a la denuncia n.° 25465-2020. Además, se le indicó que “se está solicitando a la dependencia respectiva mantener un seguimiento a la situación”.

Producto de lo anterior, el 31 de mayo de 2021, la tutelada envió un correo electrónico a un funcionario del gobierno local accionado, por medio del que señaló: “(…) En efecto ellos hicieron parte de la extracción pero al quedar el tronco en tierra el mismo sigue vivo, y esta (sic) dando nuevamente ramas, y al estar en una posición horizontal hay ramas que crecerán también hacia bajo. Aparte mi queja y la inspección de la CNE no es solo por eso. Si no por el otro alborí (sic) que esta (sic) a 10mts aproximadamente que está afectando mi propiedad por las raíces las cuales han hecho hueco en mi casa y adicionalmente porque esas son agua (sic) pluviales y otro tipo que no están entubadas y con el transcurso de los años los (sic) que era un caño sin importancia hoy tiene dimensiones mayores por no estar debidamente entubado y al estarse usando de manera indiscriminada por propiedades y condominios más arriba de nuestras casas.

Yo no necesito saber lo que ya se (sic), me refiero a la hoja 2 del pdf adjunto. Si no la solución final al problema. Nuevamente indico antes de zona verde a la par mi propiedad era N cantidad de metros ahora hay 4x7 (…)” (la negrita fue incluida). Así las cosas, el 31 de mayo de 2021, un funcionario de la Municipalidad de Alajuela dirigió un correo electrónico a “Lawrence Chacón Soto; Juan José Moya Argüello”, mediante el que manifestó “En relación con la atención y seguimiento a la denuncia de la señora Alejandra Cháves Cháves (trámite inicial N° 25465-2020), con las instrucciones superiores del caso les solicito tomar nota de lo apuntado por la contribuyente en el correo adjunto, todo con el fin de que se programe una nueva visita e inspección al sitio y valorar posible acciones en caso de ser procedentes”. (el destacado fue agregado).

Con posterioridad a que las autoridades recurridas fueran notificadas de la resolución de curso de este recurso ‑22 de noviembre de 2021‑, la Sala observa que, el 23 de noviembre de 2021, un funcionario de Prevención y Gestión del riesgo Cantonal del gobierno local accionado emitió el oficio MA-PPCI-PGRC-0752-2021, por medio del que señaló: “(…) 1. El 02 de noviembre de 2020, se generan cuatro incidentes de emergencias del Sistema 9-1-1 (2020-11-02-00432, 2020-11-02-00455, 2020-11-02-00726 y 2020-11-03-00396), los cuales indican la caída de un árbol de gran tamaño sobre una acequia que pasa al final de la Dirección02, en Desamparados, específicamente 300m noroeste y 200 al este del restaurante La Carreta (…) 2. El 03 de noviembre de 2020, se realiza una inspección al sitio donde se valida lo suscitado y se ubica un árbol de gran tamaño que peligra con la obstrucción del cuerpo de agua, además de presentarse una importante caída de material producto de la saturación de los suelos de los últimos días. 3.

Debido a lo anterior, se genera el oficio MA-PPCI-PGRC-0704-2020 el cual se remite a la Actividad de Alcantarillado Pluvial, donde amparado en las funciones propias de dicha dependencia como lo son la "Limpieza de cauces de cuerpos de agua", se solicita interponer los buenos oficios en lo suscitado, debido a que el sitio se aquejaba la necesidad de intervención urgente, pues de no atenderlo ponía en riesgo la vida de las personas que residen en la zona. Del mismo modo se copia de dicho oficio al Proceso de Seguridad Municipal y Control Vial a fin de que se intervinieran unos vehículos abandonados que se encontraban en la vía pública además se remitió copia de este al Subproceso de Gestión Ambiental y al Ministerio de Ambiente y Energía para lo correspondiente. 4. El 05 de noviembre de 2020, se recibe el oficio MA-SGV-741-2020 por parte del Subproceso de Gestión Ambiental el cual indica que en una inspección realizada al sitio el árbol se ubica dentro de la zona de protección del cuerpo de agua por lo que emitir criterio al respecto se encontraba fuera de las competencias de dicha dependencia esto de conformidad con lo que indica la Ley Forestal, por lo que recomienda la remisión del caso a la dirección del SINAC-MINAE en Alajuela para lo correspondiente. 5.

El 11 de noviembre de 2020, se recibe el oficio OA-1207 por parte del SINAC-MINAE de Alajuela, donde indican que realiza una visita al sitio en donde la especie del árbol que se encuentra es de Poró el cual esta inclinado al cauce de la Quebrada Targuá, ubicado sobre la ribera izquierda de la quebrada, además indican que se observa una gran cantidad de desechos automotrices, los cuales amenazaban con deslizarse hacia el cauce de la quebrada. Por lo anterior, dicha instancia en las recomendaciones y conclusiones indican que, al ubicarse un taller automotriz sobre los 10 m del área de protección de la Quebrada Targuá, actividad que impacta negativamente al suelo sin dejarlo recuperarse, se procederá con lo pertinente de acuerdo a la legislación vigente y además de notificar con una prevención administrativa al propietario de la propiedad, y con ello, proceda de forma inmediata aplicar las medidas correctivas del caso y en caso omiso tramitar el informe ante el Ministerio público además de indicar que se dará seguimiento para un mejor proceder. 6.

El 19 de noviembre de 2020, se recibe el oficio MA-PSMCV-1045-2020 por parte del Proceso de Seguridad Municipal y Control Vial, el cual indica que se realiza una visita al sitio donde se conversa con los propietarios de los vehículos concediéndoles un plazo de 48 horas a partir del 6 de noviembre en curso luego de eso en una visita el 19 de noviembre se logró constatar que ya los vehículos abandonados, fueron retirados de la vía pública por los propietarios atendiéndose en parte la situación descrita respecto a los vehículos ubicados en vía pública. 7. El 20 de noviembre de 2020, se recibe el informe CNE-UIAR-U986-2020 por parte de la Unidad de Investigación y Análisis del Riesgo de la Comisión Nacional de Emergencias, informe que nace a raíz de una solicitud presentada por la señora Alejandra Chaves se indica que al momento de la inspección se observa aún el árbol producto, mismo que cae cerca del cuerpo de agua posiblemente debido a la erosión de las márgenes de este cuerpo de agua, además indican que la erosión del canal ha puesto en riesgo directo una estructura que está siendo utilizada aparentemente como un taller, donde también se observa basura, y que este se encuentra a menos de 10 m del cauce.

Ante ello, en sus conclusiones indican que el árbol en el cauce representa un riesgo ya que podría causar un represamiento de no extraerse, además que la falta de protección en las márgenes del cauce y la gran cantidad de agua recogida de la parte alta, han incrementado la fuerza erosiva y los daños donde de no intervenirse el cauce y realizar una obra de protección que evite la erosión del canal se va a seguir socavando la ladera y en el futuro poner en riesgo la vivienda el taller. Finalmente, en sus recomendaciones la CNE indica que la municipalidad debe en corto plazo remover el árbol caído para evitar represamientos del cauce, además de valorar la posibilidad de realizar una obra que proteja las márgenes, y con ello, se evite la erosión, como la implementación de lagunas de retención para disminuir la vulnerabilidad desbordamientos. 8. El 17 de diciembre de 2020, se recibe el trámite N°25465-2020 el cual es remitido por la señora Alejandra Chaves en donde en su planteamiento expone la necesidad de intervención del cauce a través de la extracción de los árboles caídos como un peligro en la salida de aguas pluviales cercanas a su vivienda, debido al peligro que este representa de cara al invierno del próximo año.

Debido a lo anterior, y en vista de la necesidad de inversión del sitio el 06 de enero de 2021 se remite ante la Actividad de Alcantarillado Pluvial el oficio MA-PPCI-PGRC-0023-2021 en el cual se remite copia de los informes citados anteriormente, además de indicarse que el problema persiste debiéndose atender de manera prioritaria y urgente lo suscitado además de quedar atentos ante cualquier requerimiento para el abordaje de ello, pero en su momento no se (sic) tal necesidad. con esto se atiende lo solicitado por la señora chaves en su gestión. 9. El 09 de marzo de 2021, a través de un correo electrónico la señora Chaves inconforme con la gestión realizada indica que se reunió con el licenciado Alonso Villalobos de la Alcaldía, el cual le indico (sic) colaborarle en la gestión de lo suscitado. 10. El 20 de mayo de 2021, con el oficio MA-A-2591-2021, el licenciado Alonso Villalobos, asesor de su despacho remite para lo correspondiente copia del oficio MA-PPCI-PGRC-0023-2021 emitido por este Proceso como copia del trámite N° 25465-2020 de la señora Chaves, ante el Subproceso de Obras de Inversión Pública y la Actividad de Alcantarillado Pluvial para que de forma definitiva se produzca a la mayor brevedad la intervención que corresponda en el sitio. 11.

El 26 de mayo de 2021 mediante el oficio MA-AAP-0435-2021 la Actividad de Alcantarillado Pluvial, indica ÚNICAMENTE a la Alcaldía que en las primeras semanas del mes de diciembre atiende lo suscitado y corta gran parte del árbol caído, quedando en el sitio únicamente el tronco, eliminándose las obstrucciones y ramas caídas de este, pero peligra el tronco con caerse si se erosiona la margen del cauce, debido a su gran tamaño, indican a su vez también que, debido al tamaño del tronco y sus dimensiones, peso y posición no fue posible extraerlo con equipos o maquinaria municipal (…) 12. El 31 de mayo de 2021, mediante el oficio MA-A-2732-2021 la Alcaldía Municipal notifica a la señora Chaves sobre lo suscitado y remite copia del oficio de la Actividad de Alcantarillado Pluvial, sin embargo, la señora chaves mediante correo electrónico indica que efectivamente la municipalidad realizó la extracción, pero al quedar el tronco la tierra el mismo sigue vivo y está dando nuevamente ramas y que al estar en una posición horizontal, existen hay ramas que crecen también hacia abajo.

Además, tal y como se mencionó en el punto 8 del presente informe, parte de la queja de la señora Nombre02 se refería a una problemática con aguas pluviales que se encuentran cerca de su casa, mismas que en apariencia no están encausadas y que, con el transcurso de los años, hoy el cauce tiene dimensiones mayores por no estar debidamente canalizado, por lo que refiere sobre la necesidad de intervención de dicha problemática adicional. Finalmente, es importante resaltar que la contratación de una maquinaria a través de la Comisión Nacional de Emergencias únicamente para la extracción de dicho árbol resultaría inviable, en primer lugar, por el sitio donde se ubica, y segundo debido a que una empresa que posea maquinaria pesada (Pala Excavadora) no atendería una tarea que puede desarrollarse en menos de dos horas ya que logísticamente el traslado y el emplazamiento de esta maquinaria es complejo.

Técnicamente resulta inviable el solicitar dicha maquinaría, lo que se Sugiere es la extracción de dicho árbol a través de una contratación especial para la corta este en secciones más pequeñas y éstas a su vez pueden ser extraída de manera eficiente. Por tanto, este Proceso ha gestionado todas las acciones pertinentes para la atención de la problemática suscitada en la zona pues como se ha indicado en documentos anteriores permanecemos a la disposición de colaborar con el Departamento de Alcantarillado Pluvial en las gestiones que se requieran para la atención integral de la zona, ya sea a través de la búsqueda de recursos para la atención adecuada, como de cualquier requerimiento adicional que sea necesario para una intervención definitiva” (el resaltado fue agregado).

En tanto que, el 23 de noviembre de 2021, el coordinador del Alcantarillado Pluvial y el director de Planeamiento y Construcción de Infraestructura de la Municipalidad de Alajuela emitieron el oficio MA-AAP-0954-2021, mediante el que externaron que: “(…) 3. Debido al aumento en las condiciones de las precipitaciones, todos los cauces han sufrido cambios importantes en su comportamiento, esto provocado según expertos por el cambio climático el cual ha generado que se produzcan lluvias de mayor intensidad y duración, siendo un factor totalmente exógeno a la Municipalidad de Alajuela. Sin embargo, es necesario señalar que la Municipalidad de Alajuela ha sido previsoria en el tema de manejo de las aguas pluviales para proyectos inmobiliarios o desarrollos constructivos en general y desde hace más de 10 años se tiene como requisito para la aprobación del Visto Bueno de descarga de aguas pluviales para todo proyecto de construcción de gran envergadura el establecimiento de un plan de manejo de aguas pluviales, los cuales en su mayoría (casi su totalidad) establecen la construcción de sistemas de retardo para las aguas pluviales (…) Siendo el caso, la zona que la recurrente describe como "el fundo de la zona verde", corresponde a la zona de protección de la quebrada Targuá, por lo que dentro de la misma no es factible realizar ningún tipo de construcción, según lo establece la norma. 6.

Que, en la colindancia noreste de la urbanización El Valle, se ubica un terreno por medio del cual se aprobó la descarga de aguas pluviales del proyecto "Condominio Azul", mismo que cumple con los lineamientos establecidos por la Municipalidad de Alajuela, entre ellos el establecimiento de un plan de manejo de aguas pluviales, en este caso la construcción de un tanque de retención de aguas con capacidad para 415,90m3, tal y como lo apunta la señora Chaves Chaves en su Recurso de Amparo. 7. Con relación a la solicitud que ha realizado la recurrente para que se "entube ese paso de aguas", es necesario mencionar que los cauces naturales por sus condiciones no deben ser entubado (salvo casos especiales) esto debido a que ese proceso (de entubar), elimina de la flora y fauna que puedan proliferar en la zona de protección la cual fue creada principalmente para la preservación de la naturaleza (…) 10.

Sobre la erosión que pudiera tener la propiedad de la recurrente. el hecho podría obedecer a factores naturales como lo son el cambio del curso de la quebrada (cuyo origen podría ser algún evento sísmico, la sedimentación del cauce en algún punto u otros) o si existe una invasión a la zona de protección, en cuyo caso correspondería a otras instituciones determinar la condición en que se encuentra la propiedad y las construcciones de la recurrente. 11. En cuanto a la afectación por las raíces de los árboles, resulta improbable conocer con certeza cual (sic) o cuales (sic) los árboles poseen raíces que alcancen la propiedad de la señora Chaves Chaves, por lo que para tomar alguna acción al respecto se tendrían que talar todos los árboles ubicados en la zona de protección de la quebrada y aledaños al inmueble afecta, situación que afectaría de manera contraria la naturaleza de las zonas de protección” (la negrita fue añadida).

De otro lado, el 24 de noviembre de 2021, el coordinador de la Actividad de Control Constructivo de la Municipalidad de Alajuela emitió el oficio MA-ACC-4710-2021, por medio del que detalló que: “(…) 3. Se desliga que la propiedad de la denunciante corresponde a la finca matrícula 2-242586-ooo plano catastrado A-842537-1989 colindante con la zona de Protección de la Quebrada Targuá, de ahí que la Sra. Chaves referencie como "caño" el margen de la quebrada este cuenta con un porcentaje de terreno bajo finca matrícula -coo plano catastrado a nombre de la Asoc. Desarrollo Integral Bella Vista Alajuela. 4. Con respecto a la problemática denunciada por la Sra. Alejandra Chaves consideramos pertinente coordinar con los departamentos de Alcantarillado Pluvial y la oficina de Gestión y Prevención de Riesgo Municipal a fin de dar seguimiento a los trabajos realizados en sitio, por tratarse de competencias propias de ellos.

Tomando en consideración los argumentos expuestos de los desarrollos habitacionales vecinos; los mismos han cumplido a cabalidad con la normativa vigente toda la documentación se encuentra incorporada en los diferentes expedientes administrativos. Ahora bien, ya serán los departamentos técnicos en la materia que brinden la información y la solución a la problemática de descarga de agua no solo pluvial jabonosa como también de aguas negras, como se indica en el escrito presentado por la Sra. Chaves Chaves (…)”.

En virtud de lo anterior, esta Cámara Constitucional acredita la conculcación de los derechos fundamentales de la parte tutelada, debido a la demora de la Municipalidad de Alajuela en dar una solución definitiva a la problemática acusada desde noviembre de 2020. Al respecto, la Sala observa que, desde el 17 de noviembre de 2020 ‑con fecha de recibido 24 de noviembre de 2020‑, la amparada planteó una gestión ante la corporación municipal recurrida, mediante la cual expuso que cerca de su vivienda existe un “caño” cuyas aguas se estancan y generan malos olores; además, cuyo caudal se ha incrementado a tal punto de que ha ocasionado erosión en el terreno. De igual forma, la accionante refirió que en tal lugar hay dos árboles que generan riesgo de caídas, lo que podría ocasionar inundaciones y afectar su vivienda. Por lo anterior, solicitó “que ese segundo árbol sea cortado y que ambos sean llevados y sacados del cañó (sic), porque de llover mucho se llenaría y se nos puede inundar las casas y lo segundo es que por favor sea entubado ese paso de agua que en apariencia es pluvial y jabonosa para evitar que siga lavando terreno aparte de lo ya mencionado de olores y plagas”.

Asimismo, de importancia para la resolución de este asunto se tiene que, el 19 de noviembre de 2020 ‑notificado el día siguiente a la Municipalidad de Alajuela‑, la CNE emitió el informe técnico CNE-UIAR-INF-0986-2020 “Valoración de riesgo de inundación e inestabilidad de terreno por colapso de árbol en cauce”, en el que se indicó: “I. Información general Por solicitud de la interesada el día 12 de noviembre se realizó la evaluación visual de nesgo en Desamparados de Alajuela, por la erosión de un cauce que indujo el colapso de un árbol (…) V. Conclusiones A. Aparentemente la erosión del cauce socavo (sic) las raíces del árbol y se dio el colapso. B. Según lo que se observó en el campo y analizando el mapa y las fotos aéreas este cauce no es natural y es un alcantarillado que recoge las aguas de las viviendas de la parte alta de la cuenca. C. La falta de protección en las márgenes del cauce y la gran cantidad de agua recogida de la parte alta han incrementado la fuerza erosiva y los daños.

D. El árbol en el cauce representa un riesgo ya que podría causar un represamiento. E. De no intervenir el cauce y realizar una obra de protección que evite la erosión el canal se va a seguir socavando la ladera y en un futuro poner en riesgo la vivienda y el taller. VI. Recomendaciones A. La Municipalidad debe en un corto plazo remover el árbol caído para evitar represamientos B. También debe valorar la posibilidad de realizar una obra que proteja las márgenes para que evite que se siga dando erosión e implementar lagunas de retención para disminuir la vulnerabilidad de desbordamientos. C. Cualquier obra que se debe de realizar con la supervisión de un profesional capacitado y contar con los estudios correspondientes (…)” (la negrita fue añadida).

De este modo, desde el 20 de noviembre de 2020, la CNE, a saber, la entidad rectora en lo que se refiere a la prevención de riesgos y a los preparativos para atender situaciones de emergencias (ley n.° 8488), señaló que el cauce ubicado cerca de la vivienda de la recurrente no es natural, sino que es un alcantarillado que recoge las aguas de las viviendas de la parte alta de la cuenta, así como que la falta de protección de los márgenes del cauce ha incrementado la fuerza erosiva. De igual forma, la CNE fue enfática al señalar que “De no intervenir el cauce y realizar una obra de protección que evite la erosión el canal se va a seguir socavando la ladera y en un futuro poner en riesgo la vivienda y el taller”. En consecuencia, la CNE recomendó a la Municipalidad de Alajuela remover el árbol caído desde noviembre de 2020, así como valorar la posibilidad de realizar una obra que proteja los márgenes e implementar lagunas de retención.

Ante la problemática suscitada y las manifestaciones tanto de la recurrente como de la CNE, esta Sala verifica que la Municipalidad de Alajuela efectuó diversas actuaciones, lo que incluyó una labor de coordinación con el SINAC y la remoción parcial del árbol caído desde noviembre de 2020. Verbigracia, el 25 de mayo de 2021, el coordinador del Alcantarillado Pluvial del gobierno local recurrido emitió el oficio MA-AAP-0435-2021 dirigido al alcalde de Alajuela referente a la denuncia interpuesta por la tutelada, en el que indicó que: “esta dependencia realizó labores de eliminación del árbol que se encontraba dentro del canal y generaba obstrucción de las aguas pluviales, todo ello durante la primera semana de diciembre de 2020. Debe aclararse que únicamente quedo (sic) sin extraer el tronco principal, pero el mismo no influye en el paso del agua por la altura a la que se encuentra y por su dimensión, peso y posición no poseemos maquinaria o equipos para su extracción”.

No obstante, nótese que, desde el 31 de mayo de 2021, la tutelada reclamó ante la Municipalidad de Alajuela que la labor efectuada no subsanó la problemática acusada. Así, en tal fecha, la recurrente indicó que: “(…) En efecto ellos hicieron parte de la extracción pero al quedar el tronco en tierra el mismo sigue vivo, y esta (sic) dando nuevamente ramas, y al estar en una posición horizontal hay ramas que crecerán también hacia bajo. Aparte mi queja y la inspección de la CNE no es solo por eso. Si no por el otro alborí (sic) que esta (sic) a 10mts aproximadamente que está afectando mi propiedad por las raíces las cuales han hecho hueco en mi casa y adicionalmente porque esas son agua (sic) pluviales y otro tipo que no están entubadas y con el transcurso de los años los (sic) que era un caño sin importancia hoy tiene dimensiones mayores por no estar debidamente entubado y al estarse usando de manera indiscriminada por propiedades y condominios más arriba de nuestras casas. Yo no necesito saber lo que ya se (sic), me refiero a la hoja 2 del pdf adjunto. Si no la solución final al problema. Nuevamente indico antes de zona verde a la par mi propiedad era N cantidad de metros ahora hay 4x7 (…)” (la negrita fue incluida).

Sobre el particular, si bien la Sala observa que, ante el nuevo reclamo planteado por la accionante, un funcionario de la Municipalidad de Alajuela remitió un correo electrónico a diversos departamentos del gobierno local, mediante el cual requirió efectuar una nueva visita al sitio y valorar las posibles acciones a desarrollar, no menos cierto es que este Tribunal no acredita que la municipalidad recurrida haya efectuado alguna otra labor a fin de solventar los problemas acusados por la amparada.

En suma, aun cuando en el sub iudice se constata que las autoridades recurridas han llevado a cabo una serie de acciones tendentes a atender el problema acusado por la amparada, como lo fue la extracción parcial de uno de los árboles ubicados cerca de su vivienda, no menos cierto es que no se tiene por demostrado que la totalidad de la problemática denunciada por la tutelada haya sido debidamente atendida y corregida. En consecuencia, en la especie, la situación de riesgo denunciada por la parte accionante se mantiene en cuanto a la amenaza generada por los árboles cuyas raíces fueron socavadas por el cauce, así como por la erosión sufrida en los márgenes de tal cauce. Lo anterior se agrava al considerar que la CNE señaló desde noviembre de 2020 que “De no intervenir el cauce y realizar una obra de protección que evite la erosión el canal se va a seguir socavando la ladera y en un futuro poner en riesgo la vivienda y el taller”. Por ende, lo procedente es declarar con lugar el recurso en los términos indicados en la parte dispositiva de este pronunciamiento.

Por último, el Tribunal no omite advertir que la pretensión de la tutelada concerniente a la indemnización de los presuntos daños sufridos en su vivienda deberán ser ventilados en la vía de legalidad ordinaria y no en esta jurisdicción especializada.

V. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa que el arroyo que pasa cerca de casa del recurrente ha incrementado el caudal de manera considerable, pues no solo discurren aguas pluviales, sino también jabonosas y negras, las cuales en época de verano se estancan y ocasionan malos olores y proliferación de mosquitos, situación que eventualmente, puede afectar la salud del amparado y la de su familia, con la violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Sofía González Barquero, Roy Delgado Alpízar, Juan José Moya Argüello y Lawrence Chacón Soto, por su orden alcaldesa, coordinador del Proceso de Planeamiento y Construcción de Infraestructura Municipal, promotor de Prevención y Gestión del Riesgo Cantonal y coordinador de la Actividad de Alcantarillado Pluvial, todos de la Municipalidad de Alajuela, o a quienes en su lugar ocupen esos cargos, que coordinen lo necesario, tomen las medidas necesarias y giren las órdenes que correspondan dentro del ámbito de sus competencias, a fin de que, en el plazo máximo de TRES MESES, contado a partir de la notificación de esta sentencia, se solucionen los problemas denunciados por la parte accionante en el memorial con fecha de recibido 24 de noviembre de 2020 y en el correo electrónico remitido el 31 de mayo de 2021. Lo anterior se dicta con el apercibimiento de que, con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quienes recibieren una orden que deban cumplir o hacer cumplir, dictada en un recurso de amparo y que no la cumplieren o no la hicieren cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de Alajuela al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Salazar Alvarado consigna nota. Notifíquese.
