Background:
On the other hand, through Report No. GSD-UEN-AP-2021-01330, dated October 25, 2021, it is stated: 'In response to writ of amparo (recurso de amparo) No. 21-020683-0007-CO filed by Mr. [Nombre01 001], I am reporting on the actions taken to date and the current status of the project, which has been coordinated jointly with ASADA Piedras Blancas de Osa Puntarenas. 1- Initially, we worked on the negotiation of an agreement with the cooperative COOPEAGROPAL (attached) to obtain the permit for intake (captación) and construction of works on its property; that agreement reached a satisfactory conclusion, and the owner's authorization for the construction of works was secured. 2- In parallel, work is also currently under way on the review of the final designs for the project, which will enable improvements to the water system as well as an expansion of the service area to provide drinking water to the settlements of Salamá, Finca Puntarenas, Finca Guanacaste, Venecia, and areas of the zone yet to be developed. 3- Likewise, ASADA submitted to IMAS a request for funds for the construction of a storage tank for the project. (…)
Review of the final project designs. In addition to the completed works cited above, which are essential for the integrated expansion and improvement project for the Piedras Blancas de Osa de Puntarenas water system, technical accompaniment and support has been provided to ASADA Piedras Blancas by the UEN Project Administration staff of the Sub-Management for Delegated Systems of the Instituto Costarricense de Acueductos y Alcantarillados (AyA), with the objective of generating the final designs (design report, detailed budgets, and construction drawings) in full compliance with the AyA Technical Standard for the Design and Construction of Drinking Water Supply, Sanitation, and Stormwater Systems (Norma Técnica para Diseño y Construcción de Sistemas de Abastecimiento de Agua Potable, de Saneamiento y Pluvial de AyA). This will provide the deliverables required for the project, which will enable improvements to the water system as well as an expansion of the service area to provide drinking water to the settlements of Salamá, Finca Puntarenas, Finca Guanacaste, Venecia, and areas of the zone yet to be developed.
Regarding the review of the final designs referenced above, ASADA Piedras Blancas informed AyA on August 9 of the current year that the company Hidrotec Internacional would no longer be responsible for the final designs, given that the company had encountered financial difficulties and that the work completed had not reached an acceptable level of progress. It was also reported that going forward, the consultant Eng. Jorge Cordero Barrantes would be responsible for the design, and that the technical staff of the UEN Project Administration of the Sub-Management for Delegated Systems is coordinating the review of the final designs and their approval for the project. The project design is currently under review by professional staff of the Sub-Management for Delegated Systems, based on information submitted by consultant Eng. Jorge Cordero Barrantes beginning in September and October 2021. As soon as the review results are available, ASADA and the consultant will once again be convened to discuss compliance with the submitted deliverables; likewise, once AyA's team grants final approval to the final designs, the project will be immediately submitted to INDER to obtain financing through the INDER-AYA Interinstitutional Commission.
ASADA's application to IMAS for financing for the construction of a tank. With AyA's technical support, ASADA submitted a financing application to IMAS for the construction of a water storage tank with a volume of 300 m3; the application for inclusion in POI 2022 was communicated to Executive President Don Juan Luis Bermúdez Madriz by Ms. Xinia Espinoza Espinoza, Regional Head of the IMAS ÁREA REGIONAL DE DESARROLLO SOCIAL BRUNCA, through Official Letter dated February 1, 2021 (IMAS-SGDS-ARDSB-0034-2021), which states, and I quote the last paragraph of that letter verbatim: "As can be seen, the financing application submitted by ASADA Piedras Blancas de Osa has followed all the corresponding evaluation processes for projects, in accordance with institutional regulations. In 2019, it was not recommended by this regional area due to technical aspects that needed to be addressed, which would have prevented the project's execution.
For 2020, ASADA submitted the corresponding documentation showing that the technical observations had been resolved; therefore, given that water supply is a priority for this regional area, the project was recommended for POI 2021; however, due to decisions made by Senior Management in the current context of the COVID-19 pandemic, it was not included in that POI. Based on the foregoing, and given that the project application is complete and is on a waiting list, we request that the possibility of including it in POI 2022 be analyzed." Based on the foregoing, we are awaiting the official confirmation of said financing by IMAS to ASADA, in order to coordinate with that organization as appropriate regarding constructive support from our technical staff.
Conclusions. The intake works for the spring (naciente) have been fully constructed, which is of particular importance for achieving supply to all the communities in the project. The review of the project's final designs, contracted by ASADA, is ongoing; once AyA grants its technical approval, the project will be submitted to INDER to obtain financing. There is a positive environment at IMAS regarding the financing of a 300 m3 storage tank, as reported in the attached IMAS letter; in this regard, AyA will provide appropriate support to ASADA during the construction phase so that the works are built in accordance with institutional regulations.' (bold emphasis ours) SECOND: NOT WITHIN OUR KNOWLEDGE: Regarding the allocation of plots (parcelas) and an alleged conflict with the Asociación de la Subasta Ganadera Independiente de la Zona Sur, we must indicate that this is not within our knowledge, as the granting of said plots does not fall within the competence of the Instituto Costarricense de Acueductos y Alcantarillados. In this regard, Lic. Boris Gamboa Valladares, through Report No. GSD-UEN-GAR-2021-04509, dated October 20, 2021, stated: '3.- Finally, it is clarified that matters related to the cattle auction and monitoring of productive projects do not fall within this Institution's competence.' (…)
Regarding the particular case of the Salamá Settlement. Now, based on the recent case law (jurisprudencia) of the Sala Constitucional, as well as the reform of Article 50 of the Constitución Política, which declares access to drinking water as a fundamental human right essential to human life, it is important to bear in mind that the same case law of the Sala Constitucional has indicated that access to drinking water is not unrestricted. In this regard, the Sala Constitucional, through Resolution No. 2018008650, issued at nine fifteen in the morning on June 1, 2018, with respect to the impossibility of granting new services when it is impossible to extend the public network, stated: "From this perspective, the Sala considers it established that the denial of water service is based on technical criteria, a fact of which even the interested party is aware, as the party itself submits evidence to that effect.
In this regard, it should be noted that the Sala has recognized the existence of the right to water; however, it has also endorsed the duty of the governed party to comply with the requirements established by state authorities in order to provide the service in question. From the record, it is apparent that the respondent authority is currently unable to provide the service due to the shortage of supply in the area and the consequent impossibility of extending the network. Therefore, it is determined that the refusal in question is not arbitrary, but rather is based on technical reasons. In light of the foregoing, the writ is dismissed." (emphasis ours) In this regard, through Report No. GSD-UEN-AP-2021-01330, dated October 25, 2021, it was stated: "Construction of intake works. With a view to making progress in the construction of works to address the drinking water problem jointly with ASADA Piedras Blancas de Osa, a negotiation process was initiated with the owner of the property where the spring for the improvement and expansion project of the current system is located; as a result of that negotiation, we were permitted to begin construction of the intake of a spring known as CIPA.
Accordingly, in 2020 an on-site inspection was carried out, with the accompaniment of staff from ASADA Piedras Blancas de Osa de Puntarenas. During that inspection, it was possible to observe and analyze the location where the intake works would be developed, as well as the surrounding area. Existing structures were observed and measurements were taken to develop a proposal for new structures to optimize the water intake system. The project consisted of constructing the CIPA spring intake, which began in October 2020. The intake was 100% completed that year, capturing the maximum possible quantity of water and directing it appropriately into the system. In addition to the intake works, the installation of a conveyance pipeline was begun using pipe that ASADA had available; said pipe is made of polyethylene with a diameter of 150 mm, which made it possible to run the line from the intake site to the public road.
Carrying out these works required human resources, the financing of which was provided in part by AyA through the hiring of workers on occasional day labor (jornales ocasionales), in order to continue and complete the construction of the water intake (captación); likewise, support was provided by ASADA workers and machinery. In addition to the foregoing, technical and professional staff from the Dirección de Construcción of the UEN Administración de Proyectos of the Subgerencia de Sistemas Delegados of AyA were engaged, including a construction foreman (maestro de obras), an Inspector, and an Engineer, who were responsible for overseeing the works to ensure compliance with AyA's technical standards. For illustrative purposes, photographs are presented showing the site before construction of the water intake and the completed water intake structure." (emphasis added).
As can be seen, AyA, in coordination with the ASADA of Piedras Blancas, with the aim of extending the water supply system (acueducto) to the settlements (asentamientos), including the Asentamiento Salamá, is coordinating with the Instituto de Desarrollo Rural for the disbursement of funds (giro de fondos) once all technical endorsements (avales técnicos) of an engineering, social, legal, and environmental nature have been obtained.
Furthermore, it has been established through Report No. GSP-RB-C-2021-00338, dated 20 de octubre del 2021, issued by official Olger Moscoso Pérez, Cantonal Cortés, that: "… At that time, ORAC had an open contract with a company providing drinking water transport services, which was used to address the community's need; however, some time later that contract expired and, due to reasons unknown to me, the service could no longer be provided. In coordination with the Regional Director at the time and myself in my capacity as the Cantonal head of Osa, ORAC requested that we assist with water distribution (reparto de agua) to that community, since we, as the Cantonal office, had an assigned tanker truck (camión Cisterna) and at that point had somewhat less work. Accordingly, as of 18 de Enero del 2021, we took responsibility for delivering drinking water to the community by tanker truck, three times a week (MONDAY, WEDNESDAY, AND FRIDAY) through the present date.
If there have been any failures at any point, these have been due to maintenance of the unit, which has experienced mechanical problems and has had to be taken to the workshop for repair; otherwise, all requested obligations have been fulfilled." Given that the petitioner does not allege a shortage of water, and that AyA has a water distribution schedule for the affected communities while the supply problem is being definitively resolved, we request that the writ be dismissed insofar as it concerns AyA.
The assignment to the Asociación Cámara de Ganaderos Independientes de la Zona Sur was carried out in accordance with INDER's regulations; therefore, the fact that there are no cattle producers in the settlement (asentamiento) does not constitute a restriction on the allocation (dotación) for the Institution, given that the institutional services are oriented toward project management, and furthermore its allocation benefits hundreds of cattle-farming families in the Región Brunca. The water-extraction well located on the premises of the Subasta Ganadera was developed for use by those facilities — where a former slaughterhouse previously existed — and not for human consumption; accordingly, there is not, nor has there ever been, any proposal for its use as a drinking-water service (servicio de agua potable), given that it does not meet the criteria for human consumption. 5. A project exists for the supply of drinking water involving the community of Salamá and other localities that currently lack a drinking-water supply service; therefore, once the project obtains technical feasibility approval (viabilidad técnica) from AyA, INDER may eventually support and facilitate the financial resources needed for its implementation."

Considering:
I.Subject of the appeal.- The appellants, who are residents of the Salamá settlement (asentamiento), canton of Osa, district of Piedras Blancas, Puntarenas, comprising 40 families and 139 inhabitants, among whom there are minors, adults, and persons with disabilities, consider their fundamental rights to have been violated. They state that INDER unilaterally decided to enter into a 3-year lease (arriendo) of 3 hectares of the Salamá settlement with the Asociación de la Subasta Ganadera Independiente de la Zona Sur, despite the fact that no member of the Salamá community belongs to that association and the only access to water in the settlement is through a well located on the leased hectares. They claim that the community has no access to water and, for that reason, they reported the situation through television media; since then, AyA has been sending a tanker (cisterna) that supplies water for human consumption only, which is moreover insufficient for the number of families.
They question the fact that, on the day they come before the Court, they are fearful because the water supply is temporary and there are no clear steps toward a definitive solution to the problem. They consider that, by granting the concession to the Subasta Ganadera, the authorities would be practically privatizing access to drinking water. They consider that the situation described violates their fundamental rights.
Of importance for the resolution of this matter, the following facts are considered duly established:
In the year 2003, INDER acquired La Finca Boruka, real property registrations (folios reales): 6-049774-000, 6-130772-000 and 6-049775-000, at a cost of 123.085.865,00 colones and an area of 1.572.042,19 square meters; this property was acquired to resolve land-tenure problems arising from the difficulties the area was experiencing. (See report submitted under oath and supporting documentation) In the year 2012, INDER carried out the subdivision (parcelación) of the Salamá settlement, establishing 23 plots (parcelas) and 7 family farms (granjas familiares). A communal area—where the plaza, school, and family farms are located—was excluded from part of plot 2. Likewise, the assignment processes for the 23 established plots were initiated, and as of this date the following situation remains: 13 parcels are assigned and 7 plots are titled. (See report submitted under oath and supporting documentation) On December 10, 2018, INDER approved the assignment of parcel (predio) P-A to the Asociación Cámara de Independientes de la Zona Sur, for the Livestock Negotiation Center Project: Subasta Salamá; this, on account of the entry into force of Ley 9036 and upon the expiration of the lease.
(See report submitted under oath and supporting documentation) The water extraction well located on the Subasta Ganadera's premises was developed for the use of those facilities, where a former slaughterhouse once operated, and not for human consumption; therefore, there is not, nor has there ever been, any plan to use it as a drinking water service, given that it does not meet the criteria for human consumption. (See report submitted under oath and supporting documentation) The residents of the Salamá Settlement have never been subscribers or users of the ASADA de Piedras Blancas de Osa water system or of the Instituto Costarricense de Acueductos y Alcantarillados. (See report submitted under oath and supporting documentation) INDER has developed infrastructure projects for development, among which the following stand out: the opening, construction, and grading of roads within the settlement, construction of the school, construction of 9 pedestrian bridges providing access to the plots, development of electrification in conjunction with ICE, and improvements to the riverbed of the Salamá river.
(See report submitted under oath and supporting documentation) A project for the supply of drinking water exists, led by ASADA Piedras Blancas, which involves the community of Salamá and other localities without drinking water supply service; once the project obtains technical feasibility (viabilidad técnica) approval from AyA, INDER may eventually support and facilitate the financial resources for its execution. (See report submitted under oath and supporting documentation) The drinking water project of ASADA de Piedras Blancas is a macro-project that seeks to supply and improve drinking water service to several communities and settlements in the district of Piedras Blancas in the canton of Osa, including Salamá. This project is led by ASADA Piedras Blancas and is included in the project portfolio of the Comisión de Aguas y Saneamiento (CAS), composed of AyA and INDER, with the objective of providing guidance and follow-up to strategic projects throughout the country.
(See report submitted under oath and supporting documentation) For the purposes of this project, ASADA contracted the services of a consulting firm to prepare the required technical study; however, the document has been returned on several occasions for adjustment and improvement based on the reviews of AyA's expert technicians. (See report submitted under oath and supporting documentation) ASADA is currently making the corrections indicated by the competent authority in order to submit and seek acceptance of the technical study. For the execution of this project, resources from IMAS are planned for the construction of a storage tank, resources from AyA for the purchase of the complete piping system, and resources from INDER for the installation of the piping that will culminate in the project's commissioning. (See report submitted under oath and supporting documentation) The project has tangible field progress built with AyA resources (a spring (naciente) intake tank) and all the administrative steps and reservations for its execution.
It is important to note that within the project timeline, approval of the technical study must be secured before proceeding with the purchase of piping (scheduled for the second semester of 2022) and subsequent installation and commissioning. (See report submitted under oath and supporting documentation)
By means of Sentencia No. 2018-15926 of 09:20 hours on September 28, 2018, this Court heard a matter filed in a similar vein to the present one, also concerning the Salamá settlement, canton of Osa, district of Piedras Blancas, Puntarenas, and on that occasion resolved as follows:
"V.- ON THE SPECIFIC CASE: In this case, the appellants are residents of Salamá, Distrito Piedras Blancas, Cantón de Osa, Province of Puntarenas. They claim that, despite applications filed since 2017 before AyA, they have not been supplied with quality water—neither through tanker trucks nor, much less, through a definitive solution to their problem. Furthermore, in the report submitted to this Court by the respondent authority, that authority acknowledges that the residents of Salamá are being affected by the water problem they describe. As a temporary solution, water purification filters have been provided to them, which gives them drinking water while the problem is permanently resolved and an aqueduct (acueducto) is built, the works for which were to be completed in the year 2020. The General Manager of AyA adds in his report that the local Comité Promejoras, made up of residents of the community, is responsible for coordinating with AyA what is necessary to provide residents with water purifiers or to place provisional supply tanks while improvements to the public water piping (cañería) are carried out, so as to permanently supply them with water through piped service.
From the factual picture described, in relation to the evidence submitted to the case record and what was reported under oath by the respondent authorities, this Court observes that the claim of the appellants has two parts. First, it alleges that they are not being supplied with water by tanker truck, as had been recommended, and second, that no definitive solution has been provided to the problem of lack of quality water despite the applications filed since the previous year. This Court will therefore address both aspects in the order indicated.
The appellants claim that AyA, the respondent, does not supply the inhabitants of Finca Puntarenas and the Salamá Settlement in the Canton of Osa, District of Piedras Blancas, Province of Puntarenas, with water through a tanker truck, and that they obtain water from a surface intake from the Salamá Viejo river, which is not fit for consumption and places at risk the health of the 51 families and the public school attended by 36 students. On this particular point, the respondent authority clarifies in its report to the Court that, although drinking water has not been provided by tanker truck, the residents of Salamá are indeed provided with drinking water through an equally valid mechanism that guarantees water quality, namely water purifiers (purificadores) installed in each dwelling of the affected community. It adds that, in order to bring water to all households, the Comité Promejoras was formed, which coordinates with AyA what is necessary to provide residents with water purifiers or to place provisional supply tanks while improvements to the public water piping are carried out.
Accordingly, it is ruled out that drinking water is not being provisionally provided to the protected parties; since, according to the respondent authority, the method used while an aqueduct is built to provide a permanent solution to the water quality problem does guarantee purification of the liquid, and the appropriate course of action is to dismiss the appeal on this point, as it does not directly affect any fundamental right of those protected. That said, this Court advises the appellants that dissatisfaction with the mechanism adopted by AyA to provide a provisional solution to the drinking water supply problem in the community of Salamá through such water purifiers may be raised before the appropriate administrative and judicial authorities. Accordingly, on this point the alleged violation is dismissed, which is hereby so declared.
VII.On the Lack of a Definitive Solution to the Drinking Water (agua potable) Problem. Regarding the second issue raised in the petition filing, concerning the failure to provide a solution for the supply of quality water to the community of "Finca Puntarenas y Asentamiento Salamá," cantón de Osa, distrito Piedras Blancas, Puntarenas, as claimed by the petitioners; it is considered established that, in response to the complaint filed by some residents in March 2018, AyA officials conducted an inspection of the site on 06 de abril de 2018 to assess the conditions of drinking water supply in the area. As a result of the technical assessment of the water supply conditions of Salamá, official memorandum UEN-GAR-2018-01365 of 13 de abril de 2018 describes that the water distributed to the protected parties is drawn directly from the Salamá Viejo River without any treatment whatsoever, and therefore cannot be considered of potable quality.
The study determined that the piping installed in Salamá includes sections of exposed PVC piping (tubería de PVC), which are vulnerable to damage from vandalism, accidents, or natural disasters such as river flooding, and is therefore considered a structure vulnerable to natural disasters. As a solution, it was assessed that ASADA de Piedras Blancas, which has the capacity to incorporate the Salamá sector, should supply it with water for a period of 25 years. To that end, an estimate was made of the infrastructure needed to enable water service to the community of Salamá from the Piedras Blancas drinking water supply system (sistema de abastecimiento de agua potable), which includes an extension from the existing 100 mm pipeline in the Piedras Blancas sector; water would then be conveyed along Dirección01 through a 150 mm pipeline to the entrance of Salamá, from which point it would be distributed through 100 mm diameter pipelines throughout the different sectors of the community.
In response to the order for supplementary evidence to aid in the ruling issued by this Chamber, the General Manager of AyA added to his sworn report that the final improvement project for the Piedras Blancas water supply system (acueducto), to provide drinking water to the communities of Salamá and Finca Puntarenas, to be carried out by the Instituto Costarricense de Acueductos y Alcantarillados and ASADA de Peñas Blancas de Osa, is projected for the end of the year 2020. He further noted that, according to a technical study commissioned by ASADA de Piedras Blancas from a private firm, it was found that the applicable technical regulations had not been complied with. In light of this situation, this Chamber finds that the inaction complained of by the petitioning party, under the circumstances established in the record, effectively constitutes a manifest and egregious violation of the fundamental rights of the residents of the community Finca Puntarenas y Asentamiento Salamá, insofar as, while the lack of water service in the indicated area is acknowledged and some meetings have been held and a committee formed with residents, and a field study has been conducted to assess how to enable service from the Piedras Blancas drinking water supply system, there is no evidence that sufficient efforts have been made to produce a comprehensive hydraulic analysis (análisis hidráulico) of the entire system, so as to identify the current and projected hydraulic behavior of the system; nor that the water supply network modeling and design (modelación y diseño de red de acueducto) to be adopted for this purpose complies with current regulations and guarantees the water supply to the affected population. The respondent authority has not submitted any document from which such conclusions could be drawn. Based on the foregoing, the writ must be granted with respect to this ground.
Based on the foregoing considerations, it is observed that the residents of the community of Finca Puntarenas y Asentamiento Salamá are not supplied with drinking water; rather, they draw it directly from the Salamá Viejo River without any treatment, because the pipeline or structure is vulnerable. As a temporary solution, the liquid is provided to them through a water-purification mechanism. Although some progress has been made in identifying the problem and attempting to provide a definitive solution through a construction project, there is no evidence that sufficient efforts have been made to carry out the extension of the water supply system, nor is any supporting documentation provided of any contracting or progress on the part of the Administración del Acueducto Rural y Alcantarillado de Piedras Blancas with engineers taking on the projects; likewise, there is no firm date for the commencement or continuation of the project.
Based on the foregoing considerations, the writ must be partially granted, with respect to the failure to implement measures aimed at providing a definitive water supply to the community of Finca Puntarenas y Salamá (…) The writ is granted. Manuel Antonio Salas Pereira, in his capacity as General Manager, and Olger Moscoso Pérez, in his capacity as Head of the Cantonal Office, both of AyA, or whoever may hold those positions, are ordered to take coordinated action with the Administración del Acueducto Rural y Alcantarillado de Piedras Blancas and other competent bodies, issuing such orders and measures as are necessary to provide a definitive solution to the drinking water supply problem in the community of Finca Puntarenas y Asentamiento Salamá; this shall be done within a period of eighteen months, counted from the notification of the judgment. During the indicated period, drinking water must be provided to the indicated community through appropriate mechanisms.
The foregoing is issued with the warning that non-compliance with the orders of this Chamber is subject to criminal penalty pursuant to Article 71 of the Ley de la Jurisdicción Constitucional. The Instituto Costarricense de Acueductos y Alcantarillados is condemned to pay the damages and losses (daños y perjuicios) caused by the facts giving rise to this ruling, which shall be assessed in enforcement proceedings before the administrative courts. Notice shall be personally served on Manuel Antonio Salas Pereira in his capacity as General Manager and on Olger Moscoso Pérez in his capacity as Head of the Cantonal Office, both of AyA, or whoever may hold those positions…".
In the case at hand (sublite), the petitioners, who are residents of Asentamiento Salamá, cantón de Osa, distrito Piedras Blancas, Puntarenas, a settlement made up of 40 families and 139 inhabitants, including minors, adults, and persons with disabilities, allege violations of their fundamental rights. They claim that INDER unilaterally decided to lease 3 hectares of Asentamiento Salamá for a period of 3 years to the Asociación de la Subasta Ganadera Independiente de la Zona Sur, despite the fact that none of the members of the Salamá community belong to that association and the only access to water for the settlement is through a well (pozo) located on the leased hectares. They allege that the community has no access to water and that, for this reason, they reported the situation through television media, and since that time AyA has been sending a water tanker (cisterna) that supplies water solely for human consumption, which is furthermore insufficient for the number of families.
They question the fact that, as of the date they filed before the Chamber, they live in fear because the water supply is temporary and there are no clear actions aimed at a definitive solution to the problem. They consider that, by granting the concession to the Subasta Ganadera, the authorities would in practice be privatizing access to drinking water. They maintain that the situation described violates their fundamental rights.
Now, from the study of the case file (expediente) and the sworn report (informe rendido bajo juramento) submitted by the respondent authorities, it is gathered that in 2003 INDER acquired La Finca Boruka, property registration folios (folios reales): 6-049774-000, 6-130772-000 and 6-049775-000, at a cost of 123.085.865,00 colones and with an area of 1.572.042,19 square meters; property that was acquired to resolve land tenure (tenencia de tierras) problems, owing to the difficulties affecting the area. Furthermore, in 2003 INDER acquired La Finca Boruka, property registration folios: 6-049774-000, 6-130772-000 and 6-049775-000, at a cost of 123.085.865,00 colones and with an area of 1.572.042,19 square meters; property that was acquired to resolve land tenure problems, owing to the difficulties affecting the area. In addition to the foregoing, in 2012 INDER carried out the subdivision into plots (parcelación) of the Salamá settlement (asentamiento), establishing 23 plots (parcelas) and 7 family farms (granjas familiares).
A communal area (área comunal) was excluded from part of Dirección02, where the town square, school, and family farms are located. Likewise, the processes of assigning the 23 plots that had been established were initiated; as of this date the situation is as follows: 13 lots (predios) have been assigned and 7 plots have been titled. On December 10, 2018, INDER approved the assignment of parcel P-A in favor of the Asociación Cámara de Independientes de la Zona Sur for the project Centro de Negoción Ganadero: Subasta Salamá; this was done by reason of the entry into force of Ley 9036 and the expiration of the lease (arrendamiento). It was further established that the water extraction well located within the premises of the Subasta Ganadera was developed for use by those facilities, where a former slaughterhouse previously existed, and not for human consumption; therefore, there is neither an existing nor a prior proposal for its use as a drinking water service, given that it does not meet the criteria for human consumption.
The Salamá Settlement has never subscribed to or been a user of the water supply system (acueducto) of the ASADA of Piedras Blancas de Osa, nor of the Instituto Costarricense de Acueductos y Alcantarillados. That INDER has developed infrastructure projects for development, among which the following stand out: the opening, construction, and grading of roads within the settlement, construction of the school, construction of 9 pedestrian bridges providing access to the plots, development of electrification in coordination with ICE, and improvements to the channel of the Salamá River. Furthermore, a project currently exists for the supply of drinking water, led by ASADA Piedras Blancas, involving the community of Salamá and other localities without drinking water supply service; therefore, once the project obtains technical feasibility (viabilidad técnica) approval from AyA, INDER may eventually provide support and facilitate the financial resources for its implementation.
The ASADA Piedras Blancas drinking water project is a macro project that seeks to supply and improve drinking water service to several communities and settlements in the Piedras Blancas district of the canton of Osa, including Salamá. This project is led by ASADA Piedras Blancas and is included in the project portfolio of the Comisión de Aguas y Saneamiento (CAS), made up of AyA and INDER, with the objective of providing guidance and monitoring of strategic projects throughout the country. For the purposes of this project, the ASADA contracted the services of a consulting firm to prepare the required technical study; however, the document has been returned on several occasions for adjustment and improvement in accordance with the reviews conducted by AyA's expert technical staff. The ASADA is currently making the corrections indicated by the competent entity in order to submit and seek approval of the technical study.
For the implementation of this project, resources from IMAS are anticipated for the construction of a storage tank (tanque de almacenamiento), resources from AyA for the purchase of the complete pipeline, and resources from INDER for the installation of the pipeline, which will culminate in the commissioning of the project. Finally, the project has tangible field advances built with AyA resources (a spring catchment tank (tanque de captación de naciente)) and all the management and reserves necessary for its implementation. It is important to note that the project timeline is contingent on approval of the technical study, after which the purchase of the pipeline is to proceed (scheduled for the second half of 2022), followed by installation and commissioning.
From the factual findings (cuadro fáctico) described above and the precedent cited in Considerando IV of this judgment (sentencia), this Court finds a violation of the fundamental rights (derechos fundamentales) of the petitioners (amparados). It should be noted that, in judgment No. 2018-15926 of 09:20 hours on September 28, 2018, this Court had ordered Manuel Antonio Salas Pereira, in his capacity as General Manager, and Olger Moscoso Pérez, in his capacity as Head of the Canton Office, both of AyA, or whoever may occupy those positions, to coordinate with the Administration of the Acueducto Rural y Alcantarillado de Piedras Blancas and other competent bodies to issue the orders and measures necessary to provide a definitive solution to the drinking water supply problem affecting the communities of Finca Puntarenas and Asentamiento Salamá; this was to be done within eighteen months from the notification of the judgment, and during that period the indicated community was to be supplied with drinking water through appropriate mechanisms.
However, although the allotted time has long since elapsed, and while as of the date of submission of the reports certain efforts directed toward providing a definitive solution are observable, it is no less true that the definitive solution has not yet been achieved, since, as reported, the parties are awaiting a technical report which, once approved, would allow them to begin purchasing the pipeline, installing it, and commissioning the project, which they estimate would begin in the second half of 2022. Under these circumstances, the writ must be granted, with the consequences set forth in the operative part (parte dispositiva) of this judgment.
V.ON THE LEASE OF THE THREE HECTARES THAT THE PETITIONING PARTY CLAIMS INDER GRANTED TO THE SUBASTA GANADERA INDEPENDIENTE DE LA ZONA SUR. From the study of the case file and the sworn report submitted by the respondent authorities, it is gathered that in 2003 INDER acquired La Finca Boruka, property registration folios: 6-049774-000, 6-130772-000 and 6-049775-000, at a cost of 123.085.865,00 colones and with an area of 1.572.042,19 square meters; property that was acquired to resolve land tenure problems, owing to the difficulties affecting the area. Furthermore, in 2003 INDER acquired La Finca Boruka, property registration folios: 6-049774-000, 6-130772-000 and 6-049775-000, at a cost of 123.085.865,00 colones and with an area of 1.572.042,19 square meters; property that was acquired to resolve land tenure problems, owing to the difficulties affecting the area. From the factual findings described, this Court finds no violation of the fundamental rights of the petitioner. It should be noted that said assignment came about, first, as a consequence of the entry into force of Ley No. 9036 and, additionally, of the prior lease. In any event, this issue is a matter of ordinary statutory law (legalidad ordinaria) that the parties must, if they deem it appropriate, pursue before the corresponding administrative and judicial forums in order to fully present their arguments and enforce their claims. Under these circumstances, with regard to this issue, the alleged violation is dismissed, as hereby stated.
The parties are hereby advised that if any paper documents, objects, or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device have been submitted, these must be retrieved from the court office (despacho) within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in session N° 43-12 held on May 3, 2012, Article LXXXI.
Por tanto:
The writ is partially granted, solely with respect to access to drinking water. Fernando Vílchez Rojas, Deputy Manager for Community Systems Management (Subgerente de Gestión de Sistemas Comunales), and Olger Moscoso Pérez, Head of the Osa Canton Office, both of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever may occupy those positions, are hereby ordered to coordinate with the Administration of the Acueducto Rural y Alcantarillado de Piedras Blancas and other competent bodies to issue the orders and measures necessary to provide a definitive solution to the drinking water supply problem affecting the communities of Finca Puntarenas and Asentamiento Salamá; this must be accomplished within twelve months from the notification of this judgment. During the indicated period, the supply of drinking water to the indicated community must continue through appropriate mechanisms.
The foregoing is hereby ordered with the admonishment that non-compliance with the orders of this Court is subject to criminal sanction pursuant to Article 71 of the Ley de la Jurisdicción Constitucional. The Instituto Costarricense de Acueductos y Alcantarillados is hereby ordered to pay the damages (daños y perjuicios) caused by the acts that gave rise to this ruling, to be determined through enforcement of judgment (ejecución de sentencia) proceedings before the administrative courts. Resultando:
Redacta el Magistrado Solano Aguilar ; y,
Considerando:
I.Objeto del recurso.- Los recurrentes, quienes son residentes del asentamiento Salamá, cantón de Osa, distrito Piedras Blancas, Puntarenas, compuesto por 40 familias y 139 habitantes, entre los cuales hay menores y mayores de edad y personas con discapacidad, estiman lesionados sus derechos fundamentales. Indican que, el INDER de forma unilateral decidió dar en arriendo de 3 años, 3 hectáreas del asentamiento Salamá, a la Asociación de la Subasta Ganadera Independiente de la Zona Sur, a pesar de que no hay ningún socio de la comunidad Salamá y el único acceso al agua del asentamiento es por medio de un pozo que se ubica en las hectáreas concesionadas. Reclaman que, la comunidad no tiene acceso al agua y por tal motivo denunciaron la situación a través de los medios televisivos y desde ese momento el AyA envía una cisterna que abastece agua solo para consumo humano que, además, no es suficiente para la cantidad de familias. Cuestionan que al día que acuden a la Sala, sienten temor pues el suministro de agua es temporal y no existen acciones claras de solución definitiva al problema. Consideran que, al otorgarle la concesión a la Subasta Ganadera, las autoridades estarían prácticamente privatizando el acceso al agua potable. Estiman que la situación descrita lesiona sus derechos fundamentales.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
En el año 2003 el INDER adquirió La Finca Boruka, folios reales: 6-049774-000, 6-130772-000 y 6-049775-000, con costo de 123.085.865,00 colones y un área de 1.572.042,19 metros cuadrados; propiedad que, se adquiere para solucionar problemas de tenencia de tierras, en razón de la problemática que presentaba la zona. (Ver informe rendido bajo fe de juramento y documentación aportada) En el año 2012, el INDER logró realizar parcelación del asentamiento de Salamá, estableciéndose 23 parcelas y 7 granjas familiares. Parte de la parcela 2, se le excluyó un área comunal, donde se encuentra la plaza, escuela, y granjas familiares. Asimismo, se iniciaron los procesos de asignación de las 23 parcelas que se establecieron quedando a la fecha, la siguiente situación: 13 predios se encuentran asignados y 7 parcelas tituladas. (Ver informe rendido bajo fe de juramento y documentación aportada) El 10 de diciembre de 2018 el INDER aprobó la asignación del predio P-A, a favor de la Asociación Cámara de Independientes de la Zona Sur, para el proyecto Centro de Negoción Ganadero: Subasta Salamá; lo anterior, con motivo de la entrada en vigencia de la Ley 9036 y ante el vencimiento del arrendamiento.
(Ver informe rendido bajo fe de juramento y documentación aportada) Que el pozo para extracción de agua que se encuentra en las instalaciones de la Subasta Ganadera fue desarrollado para uso de las instalaciones, donde anteriormente existió un antiguo matadero, no así para consumo humano, por lo cual, no existe, ni existió ningún planteamiento para un aprovechamiento como servicio de agua potable, en razón de que no se reúnen con criterios para consumo humano. (Ver informe rendido bajo fe de juramento y documentación aportada) Que el Asentamiento de Salamá nunca han sido abonados ni usuarios del sistema de la ASADA de Piedras Blancas de Osa ni del Instituto Costarricense de Acueductos y Alcantarillados. (Ver informe rendido bajo fe de juramento y documentación aportada) Que el INDER ha desarrollado proyectos de Infraestructura para el desarrollo, entre los que se destaca: la apertura, construcción y conformación de caminos dentro del asentamiento, construcción de la escuela, construcción de 9 puentes peatonales que dan acceso a la parcela, desarrollo de la electrificación, en conjunto con ICE y mejoras en el cauce del río Salamá.
(Ver informe rendido bajo fe de juramento y documentación aportada) Existe proyecto para el abastecimiento de agua potable, el cual es liderado por ASADA Piedras Blancas, que involucra la comunidad de Salamá y otras localidades sin servicio de abastecimiento de agua potable, por lo que una vez que el proyecto cuente con la viabilidad técnica del AyA, el Inder eventualmente podrá apoyar y facilitar el recurso económico para su ejecución. (Ver informe rendido bajo fe de juramento y documentación aportada) El proyecto de agua potable de la ASADA de Piedras Blancas es un proyecto macro que busca abastecer y mejorar el servicio de agua potable a varias comunidades y asentamientos del distrito de Piedras Blancas en el cantón de Osa, entre ellas Salamá. Este proyecto es liderado por ASADA Piedras Blancas, y se encuentra en la cartera de proyectos de la Comisión de Aguas y Saneamiento (CAS) integrada por AyA e Inder con el objetivo de dar acompañamiento, seguimiento a proyectos estratégicos en todo el país.
(Ver informe rendido bajo fe de juramento y documentación aportada) Para los efectos de este proyecto, la ASADA contrató los servicios de una empresa consultora para la elaboración del estudio técnico requerido, sin embargo, el documento ha sido devuelto en varias ocasiones para ser ajustado y mejorado según las revisiones de los técnicos expertos del AyA. (Ver informe rendido bajo fe de juramento y documentación aportada) Actualmente la ASADA se encuentra corrigiendo lo señalado por la entidad competente para presentar y buscar la aceptación del estudio técnico. Para la ejecución de este proyecto se prevé recursos del IMAS para la construcción de un tanque de almacenamiento, recursos del AyA para la compra de la tubería completa, y recursos del Inder para la instalación de la tubería que concluirá en la puesta en marcha del proyecto. (Ver informe rendido bajo fe de juramento y documentación aportada) El proyecto, cuenta con avances tangibles en el campo construidos con recursos del AyA (tanque de captación de naciente) y todas las gestiones y reservas para su ejecución.
Es importante indicar que la línea del tiempo del proyecto, debe contarse con la aprobación del estudio técnico, para que se proceda con la compra de tubería (prevista para el II semestre de 2022) y posterior instalación y puesta en marcha. (Ver informe rendido bajo fe de juramento y documentación aportada)
Mediante la Sentencia No. 2018-15926 de las 09:20 horas del 28 de setiembre de 2018, esta Sala conoció de un asunto interpuesto en similar sentido al presente y precisamente en el asentamiento Salamá, cantón de Osa, distrito Piedras Blancas, Puntarenas, en esa ocasión resolvió lo siguiente:
“V.- SOBRE EL CASO CONCRETO: En este caso, los recurrentes son vecinos de Salamá Distrito Piedras Blancas del Cantón de Osa, de la Provincia de Puntarenas. Reclaman que pese a gestiones planteadas desde el año 2017 ante el AyA, no se les abastece de agua de calidad, ni a través de cisternas y mucho menos a través de una solución definitiva a su problema. Por otra parte, en el informe dado a esta Sala por parte de la autoridad recurrida, esta admite que los vecinos de Salamá están siendo afectados por el problema de agua que describen. Como solución temporal, les han facilitado unos filtros de purificación, lo que les procura agua potable, mientras se resuelve de manera permanente el problema y se construye un acueducto, cuyas obras estarán terminadas en el año 2020. El Gerente General del AyA añade en su informe que el Comité Promejoras local, conformado por vecinos del lugar, tiene a su cargo la coordinación necesaria para dotar a los vecinos de esos purificadores de agua o bien para colocar tanques de abastecimiento provisional, mientras se realizan las mejoras, para suministrarles permanentemente agua mediante cañería.
Del cuadro fáctico descrito, en relación con las pruebas aportadas a los autos y lo informado bajo juramento por parte de las autoridades accionadas, esta Sala observa que el reclamo de la parte recurrente contiene dos partes. En primer lugar acusa que no se les abastece de agua en camión cisterna, como había sido recomendado y en segundo lugar, que al problema de falta de agua de calidad no se le ha dado una solución definitiva pese a las gestiones planteadas desde el año pasado. Por ello, se referirá esta Sala a ambos aspectos, en el orden indicado.
Los recurrentes reclaman que el AyA recurrido no procura a los habitantes de la Finca Puntarenas y Asentamiento Salamá del Cantón de Osa, Distrito Piedras Blancas de la Provincia de Puntarenas, el agua a través de camión cisterna y se abastecen de agua a partir de una toma superficial en el río Salamá Viejo; que no está en condiciones de ser consumida y pone en riesgo la salud de las 51 familias y la escuela pública conformada por 36 estudiantes. Sobre este punto en particular, la autoridad recurrida aclara en su informe a la Sala que si bien no se ha procurado el agua potable a través de un camión cisterna, a los vecinos de Salamá sí se les brinda el servicio de agua potable a través de un mecanismo igualmente válido, que garantiza la calidad del agua, cual es el de purificador que se instala en cada vivienda de la comunidad afectada. Agrega que para llevar el agua a todos los hogares, se conformó el Comité Promejoras, que coordina con el AyA lo necesario para dotar a los vecinos de purificadores de agua o bien la colocación de tanques de abastecimiento provisional, mientras se realizan las mejoras en la cañería pública.
Así las cosas, se descarta que no se procure de agua potable de modo provisional a los amparados; pues según la autoridad recurrida el método que se usa mientras se construye un acueducto que dé una solución permanente al problema de calidad del agua, sí garantiza la purificación del líquido y lo que procede es desestimar el recurso en cuanto a este extremo, por no afectar directamente ningún derecho fundamental de los tutelados. Ahora bien, advierte esta Sala a los recurrentes que, la disconformidad con el mecanismo adoptado por el AyA para dar una solución provisional al problema de abastecimiento de agua potable en la comunidad de Salamá, a través de tales purificadores de agua; puede presentarse ante las instancias administrativas y judiciales que correspondan. Así las cosas, en cuanto a este extremo se descarta la violación acusada, lo que en efecto se hace.
VII.De la falta de solución definitiva al problema de agua potable . En cuanto al segundo aspecto que se plantea en el escrito de interposición, en relación con la falta de solución al abastecimiento de agua de calidad a la comunidad de la "Finca Puntarenas y Asentamiento Salamá", cantón de Osa, distrito Piedras Blancas, Puntarenas que reclaman los recurrentes; se tiene por acreditado que en atención al reclamo presentado por algunos vecinos en marzo de 2018, funcionarios del AyA realizaron una inspección al lugar el 06 de abril de 2018 para evaluar las condiciones de abastecimiento de agua potable en el sector. Como resultado de la valoración técnica de las condiciones de abastecimiento de agua de Salamá", por el oficio UEN-GAR-2018-01365 del 13 de abril de 2018, se describe que el agua que se distribuye a los tutelados es captada del río Salamá Viejo directamente sin ningún tipo de tratamiento, por lo que no se puede considerar de calidad potable.
En el estudio realizado se determinó que la tubería instalada en Salamá presenta tramos de tubería de PVC expuestos, los cuales son vulnerables a daños por vandalismo, accidentes o desastres naturales, como las crecidas del río, por lo que se considera una estructura vulnerable a desastres naturales. Como solución, se valora que la ASADA de Piedras Blancas, que cuenta con la capacidad de incorporar al sector de Salamá, sea quien la abastezca de agua por un periodo de 25 años. Para tales efectos, se realizó una estimación de la infraestructura necesaria para habilitar el servicio a la comunidad de Salamá a partir del sistema de abastecimiento de agua potable de Piedras Blancas lo que incluye una extensión a partir de la tubería de 100 mm existente en el sector de Piedras Blancas y a lo largo de la Dirección01 se conduciría el agua con una tubería de 150 mm hasta la entrada de Salamá, a partir de donde se distribuye mediante tuberías de 100 mm de diámetro en los distintos sectores de la comunidad.
En atención a la prueba para mejor resolver ordenada por esta Sala, el Gerente del AyA añade a su informe dado bajo juramento que el proyecto definitivo de mejoras en el acueducto de Piedras Blancas, para abastecer de agua potable a las comunidades de Salamá y Finca Puntarenas, por parte del Instituto Costarricense de Acueductos y Alcantarillados y la Asada de Peñas Blancas de Osa se proyecta para finales del año 2020. Agrega que según un estudio técnico contratado por la ASADA de Piedras Blancas a una empresa privada, se revela que no se ha cumplido con la normativa técnica. Ante ese panorama, considera esta Sala que la inercia que reclama la parte recurrente, bajo las circunstancias que se constatan en los autos, efectivamente constituye una vulneración abierta y grosera de los derechos fundamentales de los vecinos de la comunidad Finca Puntarenas y Asentamiento Salamá, en el tanto si bien se admite la falta del servicio de agua en el sector indicado y que se han realizado algunas reuniones y conformado un comité con los vecinos y mediante un estudio de campo en el que se valora cómo habilitar el servicio a partir del sistema de abastecimiento de agua potable de Piedras Blancas, no consta que se hayan realizado los esfuerzos suficientes para elaborar un análisis hidráulico del sistema completo, de forma que se pueda identificar el comportamiento hidráulico actual y proyectado del sistema; y que la modelación y diseño de red de acueducto que se adopte con este fin, cumpla la normativa vigente y garantice el suministro de agua a la población afectada. No aporta la autoridad recurrida, ningún documento del que se desprenda. Con base en lo anteriormente expuesto, procede acoger el recurso en cuanto a este extremo.
Con base en las consideraciones anteriores, se observa que los habitantes de la comunidad de Finca Puntarenas y Asentamiento Salamá no son abastecidos de agua potable sino que la captan del río Salamá Viejo directamente sin ningún tipo de tratamiento, porque la tubería o estructura es vulnerable. Como solución temporal se les provee el líquido, a través de un mecanismo que limpia el agua. No obstante se han realizado algunos avances para detectar el problema e intentar dar una solución definitiva a través de una obra de construcción, no consta que se hayan realizado los esfuerzos suficientes para construir la ampliación del acueducto ni se aporta prueba que respalde alguna contratación y avance de parte de las Administración del Acueducto Rural y Alcantarillado de Piedras Blancas con ingenieros que asuman los proyectos; así como tampoco existe fecha firme para dar inicio al proyecto o continuación de este.
Con base en las consideraciones expuestas, procede declarar parcialmente con lugar el recurso, en cuanto la falta de implementación de actos tendientes a dotar de agua de manera definitiva a la comunidad de Finca Puntarenas y Salamá (…) Se declara con lugar el recurso. Se ordena a Manuel Antonio Salas Pereira en su calidad de Gerente General y a Olger Moscoso Pérez, en su condición de Jefe de la Oficina Cantonal, ambos del AyA o a quienes ocupen tales cargos, que dispongan de forma coordinada, con la Administración del Acueducto Rural y Alcantarillado de Piedras Blancas así como demás órganos competentes, las órdenes y medidas necesarias a fin de dar solución definitiva al problema de abastecimiento de agua potable a la comunidad de Finca Puntarenas y Asentamiento Salamá; ello dentro de un término de dieciocho meses, contado a partir de la notificación de la sentencia. Durante el tiempo indicado deberá dotarse de agua potable a la comunidad indicada mediante los mecanismos idóneos.
Lo anterior, apercibido de que la desobediencia a las órdenes de esta Sala se encuentra sancionado penalmente según lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional. Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de los daños y perjuicios ocasionados por los hechos que han dado lugar a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. NOtifíquese personalmente a Manuel Antonio Salas Pereira en su calidad de Gerente General y a Olger Moscoso Pérez, en su condición de Jefe de la Oficina Cantonal, ambos del AyA o a quienes ocupen tales cargos…”.
En el sublite, Los recurrentes, quienes son residentes del asentamiento Salamá, cantón de Osa, distrito Piedras Blancas, Puntarenas, compuesto por 40 familias y 139 habitantes, entre los cuales hay menores y mayores de edad y personas con discapacidad, estiman lesionados sus derechos fundamentales. Acusan que, el INDER de forma unilateral decidió dar en arriendo de 3 años, 3 hectáreas del asentamiento Salamá, a la Asociación de la Subasta Ganadera Independiente de la Zona Sur, a pesar de que no hay ningún socio de la comunidad Salamá y el único acceso al agua del asentamiento es por medio de un pozo que se ubica en las hectáreas concesionadas. Cuestionan que al día que acuden a la Sala, sienten temor pues el suministro de agua es temporal y no existen acciones claras de solución definitiva al probleman. Consideran que, al otorgarle la concesión a la Subasta Ganadera, las autoridades estarían prácticamente privatizando el acceso al agua potable. Estiman que la situación descrita lesiona sus derechos fundamentales.
Ahora bien, del estudio del expediente y del informe rendido bajo juramento por las autoridades recurridas, se extrae que, en el año 2003 el INDER adquirió La Finca Boruka, folios reales: 6-049774-000, 6-130772-000 y 6-049775-000, con costo de 123.085.865,00 colones y un área de 1.572.042,19 metros cuadrados; propiedad que, se adquiere para solucionar problemas de tenencia de tierras, en razón de la problemática que presentaba la zona. Aunado a lo anterior que, el año 2012, el INDER logró realizar parcelación del asentamiento de Salamá, estableciéndose 23 parcelas y 7 granjas familiares.
Parte de la Dirección02, se le excluyó un área comunal, donde se encuentra la plaza, escuela, y granjas familiares. Asimismo, se iniciaron los procesos de asignación de las 23 parcelas que se establecieron quedando a la fecha, la siguiente situación: 13 predios se encuentran asignados y 7 parcelas tituladas. El 10 de diciembre de 2018 el INDER aprobó la asignación del predio P-A, a favor de la Asociación Cámara de Independientes de la Zona Sur, para el proyecto Centro de Negoción Ganadero: Subasta Salamá; lo anterior, con motivo de la entrada en vigencia de la Ley 9036 y ante el vencimiento del arrendamiento. Se acreditó además que, Que el pozo para extracción de agua que se encuentra en las instalaciones de la Subasta Ganadera fue desarrollado para uso de las instalaciones, donde anteriormente existió un antiguo matadero, no así para consumo humano, por lo cual, no existe, ni existió ningún planteamiento para un aprovechamiento como servicio de agua potable, en razón de que no se reúnen con criterios para consumo humano.

Para la ejecución de este proyecto se prevé recursos del IMAS para la construcción de un tanque de almacenamiento, recursos del AyA para la compra de la tubería completa, y recursos del Inder para la instalación de la tubería que concluirá en la puesta en marcha del proyecto. Finalmente que, proyecto, cuenta con avances tangibles en el campo construidos con recursos del AyA (tanque de captación de naciente) y todas las gestiones y reservas para su ejecución. Es importante indicar que la línea del tiempo del proyecto, debe contarse con la aprobación del estudio técnico, para que se proceda con la compra de tubería (prevista para el II semestre de 2022) y posterior instalación y puesta en marcha.
Del cuadro fáctico descrito y del antecedente citado en en considerando IV de esta sentencia, este Tribunal acredita la lesión a los derechos fundamentales de los amparados. Nótese que, esta Sala desde la sentencia No. No. 2018-15926 de las 09:20 horas del 28 de setiembre de 2018, esta Sala había ordenado a Manuel Antonio Salas Pereira en su calidad de Gerente General y a Olger Moscoso Pérez, en su condición de Jefe de la Oficina Cantonal, ambos del AyA o a quienes ocupen tales cargos, que dispusieran de forma coordinada, con la Administración del Acueducto Rural y Alcantarillado de Piedras Blancas así como demás órganos competentes, las órdenes y medidas necesarias a fin de dar solución definitiva al problema de abastecimiento de agua potable a la comunidad de Finca Puntarenas y Asentamiento Salamá; lo anterior, dentro de un término de dieciocho meses, contado a partir de la notificación de la sentencia y que durante el tiempo indicado deberá dotarse de agua potable a la comunidad indicada mediante los mecanismos idóneos.
No obstante, habiendo transcurrido sobradamente el plazo otorgado, a la fecha de rendición de los informes, si bien es cierto, se observan gestiones tendentes a brindar esta solución definitiva; no menos cierto resulta que, la solución definitiva no se ha dado, pues según informaron, se encuentran a la espera de un informe técnico para que una vez aprobado, iniciar con la compra de tubería, la instalación y la puesta en marcha del proyecto, lo cual, estiman comenzaría a realizarse para el segundo semestre de 2022. Así las cosas, se debe declarar con lugar el recurso, con las consecuencias que se dirán en la parte dispositiva de esta sentencia.
V.SOBRE EL ARRENDAMIENTO DE LAS TRES HECTÁREAS QUE RECLAMA LA PARTE RECURRENTE, POR PARTE DEL INDER, A LA SUBASTA GANADERA INDEPENDIENTE DE LA ZONA SUR. Del estudio del expediente y del informe rendido bajo juramento por las autoridades recurridas se extrae que, en el año 2003 el INDER adquirió La Finca Boruka, folios reales: 6-049774-000, 6-130772-000 y 6-049775-000, con costo de 123.085.865,00 colones y un área de 1.572.042,19 metros cuadrados; propiedad que, se adquiere para solucionar problemas de tenencia de tierras, en razón de la problemática que presentaba la zona. Además que, en el año año 2003 el INDER adquirió La Finca Boruka, folios reales: 6-049774-000, 6-130772-000 y 6-049775-000, con costo de 123.085.865,00 colones y un área de 1.572.042,19 metros cuadrados; propiedad que, se adquiere para solucionar problemas de tenencia de tierras, en razón de la problemática que presentaba la zona.
Aunado a lo anterior que, el año 2012, el INDER logró realizar parcelación del asentamiento de Salamá, estableciéndose 23 parcelas y 7 granjas familiares. Parte de la Dirección02, se le excluyó un área comunal, donde se encuentra la plaza, escuela, y granjas familiares. Asimismo, se iniciaron los procesos de asignación de las 23 parcelas que se establecieron quedando a la fecha, la siguiente situación: 13 predios se encuentran asignados y 7 parcelas tituladas. El 10 de diciembre de 2018 el INDER aprobó la asignación del predio P-A, a favor de la Asociación Cámara de Independientes de la Zona Sur, para el proyecto Centro de Negoción Ganadero: Subasta Salamá; lo anterior, con motivo de la entrada en vigencia de la Ley 9036 y ante el vencimiento del arrendamiento.
Del cuadro fáctico descrito, este Tribunal descarta la lesión a los derechos fundamentales de la parte recurrente. Nótese que, dicha asignación se de en primer lugar, como consecuencia de la entrada en vigencia de la Ley No. 9036 y además del arrendamiento anterior. En todo caso, este extremo, es un asunto de legalidad ordinaria, que deberán si lo estiman conveniente, reclamar ante las instancias administrativas y judiciales que correspondan, a fin de realizar ampliamente sus alegatos y hacer valer sus pretensiones. Así las cosas, en cuanto a este extremo se descarta la violación acusada, lo que en efecto se hace.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente en cuanto al acceso del agua potable. Se ordena a Fernando Vílchez Rojas, Subgerente de Gestión de Sistemas Comunales y; a Olger Moscoso Pérez, Jefe de la Oficina Cantonal de Osa, ambos del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes en sus lugares ocupen tales cargos, que dispongan de forma coordinada, con la Administración del Acueducto Rural y Alcantarillado de Piedras Blancas así como demás órganos competentes, las órdenes y medidas necesarias a fin de dar solución definitiva al problema de abastecimiento de agua potable a la comunidad de Finca Puntarenas y Asentamiento Salamá; ello dentro de un término de doce meses, contado a partir de la notificación de la sentencia. Durante el tiempo indicado deberá continuarse dotando de agua potable a la comunidad indicada mediante los mecanismos idóneos. Lo anterior, apercibido de que la desobediencia a las órdenes de esta Sala se encuentra sancionado penalmente según lo dispuesto en el artículo 71 de la Ley de la Jurisdicción Constitucional. Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de los daños y perjuicios ocasionados por los hechos que han dado lugar a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese.
