Amparo proceeding (recurso de amparo) processed under case file number 21-011444-0007-CO, filed by Nombre01, identity card CED01, on behalf of EMPRESA LIMÓN LUMBER COMPANY LIMITADA, against LA MUNICIPALIDAD DE POCOCÍ, EL MINISTERIO DE SALUD Y EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).

Background 1. In a written submission received by the Chamber Secretariat on 15 de junio de 2021, the petitioner filed an amparo proceeding against the Municipalidad de Pococí, the Ministerio de Salud, and ICAA, stating that the protected company is the registered owner of Dirección01, located in the province of Limón. The petitioner states that, since 2020, the company represented filed a formal complaint with the Municipalidad de Pococí, which was also referred to the Ministerio de Salud. The petitioner indicates that the complaint stated the following: “In that complaint, I explain that, in approximately 2012, the Municipalidad de Pococi (sic), based on the existence of a small stream (The (sic) small amount of water that entered the property disappeared when the land located south of the property was developed), which entered through the southern part of the property and left through the northern part, channeled water collected from the sewerage system in the southern area into the channel through which the small stream had flowed in the past.

I do not live in Guápiles, so I was unaware of the damage being caused to the property. The damage is caused not only by the amount of water entering and eroding the land, but also because the water is contaminated with all kinds of substances. During my most recent visit to the property, I noticed that work was being performed to renovate green areas south of the property, and I believe that this is where that water should be connected to the sewer built last year in front of the cemetery (on the west side of our property).” However, as of the filing of this proceeding, the petitioner had received no response to the request from the respondent authorities. The petitioner asserts that the situation is extremely distressing because there are foul odors and pollution that may cause illnesses. For the reasons stated, the petitioner considers that the protected party’s fundamental rights have been violated.

2. By order issued at 13:58 on 16 de junio de 2021, the Presidency of the Chamber granted a hearing to the Municipalidad de Pococí and the Área Rectora de Salud de Pococí.

3. Manuel Hernández Rivera, in his capacity as Mayor, and Juan Luis Gómez Gómez, in his capacity as President of the Concejo, both of the Municipalidad de Pococí, report under oath that the request was indeed addressed by the Departamento de Desarrollo y Control. They state that the Municipalidad acted diligently through its officials, because the matter was reported to the Ministerio de Salud and ICAA, explaining the need to construct a sanitary sewerage system (alcantarillado sanitario) for Guápiles, since it is a city that has experienced significant growth. They argue that this falls within ICAA’s jurisdiction. The actions taken were communicated to the petitioner through official letter No. DDCU-240-2020 of 15 de octubre de 2020. They also state that the water in the area results from rainfall and the slope of the land and is not, strictly speaking, a body of water (cuerpo de aguas); therefore, pursuant to Article 20 of the Ley General de Caminos Públicos, the lower property is required to receive the water. They request that the proceeding be dismissed.

4. Karen Mayorga Quirós, in her capacity as Director of the Área Rectora de Salud de Pococí, reports under oath that:

“FIRST: Our records contain no complaint concerning wastewater (aguas residuales) problems filed by the petitioner herein. SECOND: We do, in fact, have complaint sequence number 302-2020, filed by MINAE via email (Complaint Code 18555-2020), which ‘states that, because of the deficient sewerage system and water pollution, strong odors are being emitted,’ at a vacant lot located opposite the Guápiles cemetery, survey plan number L-400398-1980. THIRD: The central canton of Pococí faces a nationwide reality: it has no sanitary sewerage system for wastewater treatment, and therefore homes, businesses, and industries discharge their wastewater into the curb and gutter. FOURTH: In addressing the complaint referred to above, field inspections were conducted in coordination with municipal officials from both the Departamento de Gestión Ambiental and the Departamento de Obras Civiles. FIFTH: Both officials state that CONAVI intervened two years ago in that stormwater channel, which reduced by 30% the discharge of water into the receiving water body (cuerpo receptor) on the petitioner’s property.

SIXTH: The environmental problem described herein was confirmed in the field because no sanitary sewerage network exists. (Technical Report MS-DRRSHC-ARSP-8965-2020). SEVENTH: In view of the foregoing, official letter MS-DRRSHC-ARSP-09891 was sent to Municipal Mayor Manuel Hernández Rivera so that he may take the appropriate action to ensure that the city of Guápiles has a sanitary sewerage system that ‘allows wastewater to be collected and conveyed to a treatment and discharge point within the maximum permitted limits.’ This falls within his jurisdiction under Article 169 as the ‘local government.’ EIGHTH: The municipal officials likewise referred to this in their respective official letters UTGAM-591-2020 and UTGAM-592-2020, describing in detail what was observed at the site for the purpose of providing further information. NINTH: According to the arguments presented, official letter UTGAM-591-2020 was served on the Instituto Costarricense de Acueductos y Alcantarillados for the appropriate action in its capacity as the governing authority for wastewater matters, as established by the regulations governing its responsibilities.” 5.

By decision issued at 09:05 on 05 de julio de 2021, the Justice presiding over the case expanded the order admitting the proceeding (auto de curso) and granted a hearing to the General Manager and the Head of the Oficia de Pococí, both of ICAA.

6. On 09 de julio de 2021, Justice Rueda Leal submitted a recusal request (solicitud de inhibitoria).

7. By decision issued at 16:15 on 14 de julio de 2021, the Presidency of the Chamber accepted Justice Rueda Leal’s recusal.

8. Through selection process No. 9089 conducted by the Presidency of the Corte Suprema de Justicia, Alicia María Salas Torres was appointed as substitute Justice in place of Justice Rueda Leal.

9. Eric Alonso Bogantes Cabezas, in his capacity as General Manager, and Miguel Antonio Badilla Ugalde, in his capacity as Cantonal Head of the Oficina de Pococí, both of ICAA, report under oath that:

“The appellant complains that stormwater enters his property, causing damage such as erosion and pollution. He requests that the Municipality connect that water to a culvert constructed in front of the Guápiles cemetery. On this point, it is important to indicate that stormwater systems (sistemas pluviales) are administered and maintained by the municipality; therefore, AyA would have no authority to address that first request. The property referred to by Mr. Nombre01, in his capacity as appellant (Real Property Folio 4.718-000, with Cadastral Plan L-0400398-1980, measures veintitrés mil seiscientos metros con setenta y cinco decímetros cuadrados, according to information in the literal certification). During a site inspection conducted in the company of the Technical Chief, Mr. Marvin Pérez (on 08 de Julio del 2021), the existence of a storm sewer (alcantarillado pluvial) extending to the boundary of the property was observed.

It was then observed that, beyond the storm sewer, an open-channel runoff course (escorrentía a cielo abierto) continues through the property from south to north, as can easily be seen in the attached GOOGLE photograph (Evidence N° 4). The report issued by the Director of the Área de Salud de Guápiles indicates that she received a complaint from MINAE stating that strong odors emanate from a property across from the Guápiles cemetery due to the poor condition of the sewerage system and water pollution. She asserts that Guápiles has no sanitary sewerage system (alcantarillado sanitario), and therefore homes, businesses, and industries discharge wastewater (aguas residuales) into the curb and gutter. In this regard, it should be noted that wastewater treatment systems (sistemas de tratamiento de aguas residuales) for existing structures are approved by the Ministerio de Salud and generally consist of septic tanks with drainage systems in areas where no sanitary sewerage system exists; therefore, if it had considered such treatment inadequate, it should neither have approved it nor allowed the construction of buildings.

In its report, the Área de Salud de Guápiles states that homes, businesses, and industries dispose of their wastewater into the curb and gutter rather than through the approved treatment systems. In the case of businesses and industries, that Ministry also grants operating permits and must therefore ensure the proper treatment and disposal of the wastewater generated. In any event, it is authorized to issue sanitary orders (órdenes sanitarias) to those engaging in such acts, requiring them to correct the situation and use the approved treatment system. FINALLY, IT IS IMPORTANT TO INDICATE THAT NO SANITARY SEWERAGE SYSTEM EXISTS IN THE CENTRAL AREA OF POCOCÍ. ON THE MERITS With respect to the statement that: “( ) official letter N° UTGAM-591- 2020 was served on the Instituto Costarricense de Acueductos y Alcantarillados for the appropriate action in its capacity as the governing body for wastewater matters, as established by the regulations governing its responsibilities,” it is important to indicate that none of the evidence submitted with the appeal includes any document demonstrating the foregoing.

Without prejudice to the foregoing, any potential liability in this case cannot and must not be imposed on AyA, because, in light of the principle of legality (principio de legalidad) enshrined in article 11 of the Constitución Política and also developed in article 11 of the Ley General de la Administración Pública, public authorities and institutions are subject to the legal system in a special manner, based on the fundamental rule that any public authority or institution may act only insofar as the legal system itself empowers it to do so; ordinarily, for public authorities and institutions, only that which is expressly authorized by the Constitution and the law is permitted, and everything not so authorized is prohibited. Costa Rica has two separate sewerage systems: one called the “storm sewerage system” (“sistema de alcantarillado pluvial”), whose purpose is to convey rainwater from the roofs, gutters, and downspouts of homes, as well as rainwater flowing along public roads; and the other called the “sanitary sewerage system” (“sistema de alcantarillado sanitario”), whose purpose is to convey only wastewater from washbasins, sinks, showers, and toilets generated inside homes.

Under the regulations in force, storm sewerage systems are administered by the municipality of each canton, while the sanitary sewerage system is operated and maintained by the operator responsible for providing drinking-water service within its respective geographic service area. Where no sanitary sewerage system exists, wastewater must be disposed of through individual systems, namely septic tanks and their corresponding drainage systems. The storm sewerage system, whether called a natural channel, ditch, or by any other name, must be administered—and therefore kept in proper operating condition—by the municipality of each canton. The Instituto Costarricense de Acueductos y Alcantarillados (AyA) has neither authority nor operational involvement in drinking-water services, sanitation services, or administration of the stormwater system because it is not the operator of those services. In this regard, article 1 of the Ley de Construcciones (N° 833) provides: “The Municipalities of the Republic are responsible for ensuring that cities and other populated areas meet the necessary standards of safety, public health, convenience, and beauty on their public roads and in the buildings and structures erected on land within them, without prejudice to the powers granted by law in these matters to other administrative bodies.” Article 8 of the Ley para la Gestión Integral de Residuos (N° 88339) governs the functions of municipalities and clearly states that they are responsible for the comprehensive management of waste generated in their canton.

The Ley General de Salud, in turn, provides: ARTICLE 292.--The discharge of sewage (aguas negras), sullage (aguas servidas), and industrial waste into the storm sewerage system is prohibited in all cases. The Ministry is authorized to restrict, regulate, or prohibit the disposal of non-biodegradable synthetic products through systems for collecting excreta, sewage, and sullage. ARTICLE 285.--Excreta, sewage, sullage, and stormwater must be disposed of properly and hygienically to prevent contamination of the soil and natural water sources intended for human use and consumption, the formation of breeding grounds for disease vectors, and air pollution caused by conditions that compromise its purity or quality. Accordingly, we reiterate that AyA has no administrative or operational involvement at the site in question, as it lies outside its geographic service area, and the operator of both the drinking-water system and the storm sewerage system (rainwater) is necessarily the Municipality.” 10. The legal requirements have been observed in the proceedings conducted.

Justice Castillo Víquez authors the opinion; and,

Considering:

I. SUBJECT MATTER OF THE APPEAL

The appellant alleges a violation of his fundamental rights, asserting that the protected company is the registered owner of property number 4718, located in the province of Limón. He states that, since 2020, the company he represents filed a formal complaint with the Municipalidad de Pococí, which was also referred to the Ministerio de Salud. He states that the complaint set forth the following: “In that complaint, I explain that the Municipalidad de Pococi (sic), approximately in 2012, based on the fact that there had been a small stream (The (sic) small amount of water that entered the property disappeared when the land located south of the property was developed), which entered through the southern part of the property and exited through its northern part. The municipality channeled water collected from the sewerage system in the southern area into the channel through which the water from the small stream had previously flowed.

I do not live in Guápiles, so I was unaware of the damage being caused to the property. Not only because of the amount of water that enters and is eroding the land, but also because it is water contaminated with all kinds of substances. During my most recent visit to the property, I noticed that landscaping work is being performed in green areas south of the property, and it seems to me that this is where that water should be connected to the culvert constructed last year in front of the cemetery. (western side of our property).” However, as of the filing of this appeal, he had received no response to his request from the respondent authorities. He asserts that the situation is highly distressing because of the foul odors and pollution, which may cause illness.

II. PROVEN FACTS

The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been proven or because the respondent party failed to address them as directed in the initial order:

The appellant owns real property located in the province of Limón, canton of Pococí, district of Guápiles (undisputed fact).

The central canton of Pococí has no sanitary sewerage system for the treatment of sanitary wastewater (aguas sanitarias); therefore, homes, businesses, and industries discharge their wastewater into the curb and gutter (see the report of the Área Rectora de Salud de Pococí).

Costa Rica has two separate sewerage systems: one called the “Storm Sewerage System,” whose purpose is to convey rainwater from the roofs, gutters, and downspouts of homes, as well as rainwater flowing along public roads; and the other called the “Sanitary Sewerage System,” whose purpose is to convey only wastewater from washbasins, sinks, showers, and toilets generated inside homes. Under the regulations in force, storm sewerage systems are administered by the municipality of each canton, while the sanitary sewerage system is operated and maintained by the operator responsible for providing drinking-water service within its respective geographic service area (see the ICAA report).

In 2020, the appellant filed a complaint with the Municipality. In that complaint, I explain that the Municipalidad de Pococi (sic), approximately in 2012, based on the fact that there had been a small stream (The (sic) small amount of water that entered the property disappeared when the land located south of the property was developed), which entered through the southern part of the property and exited through its northern part. The municipality channeled water collected from the sewerage system in the southern area into the channel through which the water from the small stream had previously flowed. I do not live in Guápiles, so I was unaware of the damage being caused to the property. Not only because of the amount of water that enters and is eroding the land, but also because it is water contaminated with all kinds of substances. During my most recent visit to the property, I noticed that landscaping work is being performed in green areas south of the property, and it seems to me that this is where that water should be connected to the culvert constructed last year in front of the cemetery. (western side of our property)” (undisputed fact).

On an undetermined date, the Municipalidad de Pococí conducted an inspection at the reported site and determined that “this type of problem is very complex to address because of the large number of illegal wastewater (aguas residuales) discharges deposited into the storm sewer system (alcantarillado pluvial), particularly because the water affecting the property in question comes from various residential developments (urbanizaciones) (Los Almendros, Llamas del Bosque and Urbanización Toro Amarillo); this situation is an evident consequence of the lack of a sanitary sewer system (alcantarillado sanitario) in Guápiles” (see the evidence submitted by the Municipalidad de Pococí).

On 17 de septiembre de 2020, the Municipalidad de Pococí, through official letter No. UTGAM-592-2020, informed the ICAA of the need to begin the relevant studies to enable the construction of a sanitary sewer system for the city of Guápiles. That referral stated the following: “Please accept cordial greetings from the Unidad Técnica de Gestión Ambiental Municipal (UTGAM) of the Municipalidad de Pococí. The purpose of this letter is to inform you that, on 11 de setiembre de año en curso, the complaint filed through the Sistema Integrado de Trámite y Atención de Denuncias Ambientales, under number SITADA-18555-2019, was addressed. This matter was handled on an interinstitutional basis, with the participation of Licda. Ana Morales of the Área Rectora de Salud de Pococí, Ministerio de Salud; Ing. Brandon Agüero of the Unidad de Obras Civiles; and the undersigned, representing the UTGAM. The complaint was filed by Mr.

Nombre02 because of a deficient sewer system and water pollution at a property located on the east side of the Cementerio de Guápiles. It should be noted that Mr. Nombre01 is reporting a situation that, regrettably, is a reality in most Costa Rican cities: the pollution of water bodies (cuerpos de agua) that cross population centers and receive heavy wastewater loads. Licda. Morales states that this type of problem is very complex to address because of the large number of illegal wastewater discharges deposited into the storm sewer system, adding that this situation results from the lack of a sanitary sewer system in Guápiles. Complaint SITADA-18555-2019 describes a problem that will continue to grow in Pococí and that must begin to be addressed on an interinstitutional basis so that, in the medium or long term, a sanitary sewer system can be established to provide environmentally responsible treatment of the wastewater generated by the population.

In view of the foregoing, this letter is referred to the Instituto Costarricense de Acueductos y Alcantarillados to formally express the need to begin the relevant studies so that a sanitary sewer system may eventually be constructed for the city of Guápiles. The UTGAM hereby states its willingness to participate in any actions necessary for the successful completion of this project, which is of great importance to our canton” (see the evidence submitted by the Municipalidad de Pococí).

According to official letter No. OSCM-311-2021 issued by the Departamento de Obras Civiles y Servicios Municipales de Pococí, it was stated that: “Mr. Nombre03 mentions in his complaint that on his property ‘there was a small stream (quebrada), with water entering through the southern part of the property and then flowing out toward the north.’ The water body mentioned by Mr. Nombre03 is a natural depression through which rainwater flows because, according to the existing topography of the surrounding land, the water flows toward that area” (see the evidence submitted by the Municipalidad de Pococí).

According to official letter No. OSCM-311-2021 issued by the Departamento de Obras Civiles y Servicios Municipales de Pococí, it was stated that: “the Municipality channeled water collected from the sewer system in the area south of the channel through which water from a small stream flowed in the past; this description corresponds to the sewer systems of the residential developments known as ‘Los almendros’ and ‘Llamas del Bosque,’ which, at the time, channeled rainwater toward this area because it is the lowest point and the place through which the rainwater naturally flowed. Naturally, over the years, erosion has occurred and tends to increase the width of the channel” (see the evidence submitted by the Municipalidad de Pococí).

According to official letter No. OSCM-311-2021 issued by the Departamento de Obras Civiles y Servicios Municipales de Pococí, it was stated that: “In 2017, because of the flooding of homes and streets occurring in the area known as ‘Coopevigua 1,’ located on the north side of this channel—that is, downstream from where the water leaves Mr. Hasbun’s property—an intervention was carried out to eliminate at least 40% of the water being channeled onto the complainant’s property, and that water was diverted through a new sewer constructed by CONAVI at Dirección02, alongside the complainant’s property. This storm sewer fills completely during periods of heavy rain, so there is no possibility of diverting water toward that area. Given this situation, Mr. Nombre01’s request to ‘connect the water to the sewer that was built last year in front of the cemetery’ is not feasible” (see the evidence submitted by the Municipalidad de Pococí).

The petitioner (parte recurrente) has not filed any complaint with the Área Rectora de Salud de Pococí concerning the wastewater problem (see the report of the Área Rectora de Salud de Pococí).

The Área Rectora de Salud de Pococí has complaint sequential number 302-2020, filed by the Ministerio de Ambiente y Energía by email (complaint code 18555-2020), which “states that, because of the deficient sewer system and water pollution, strong odors are emitted at a site across from the Cementerio de Guápiles, on an undeveloped lot, survey plan number L-400398-1980” (see the report of the Área Rectora de Salud de Pococí).

In response to the complaint filed by MINAE, the Área Rectora de Salud and the Municipalidad de Pococí conducted inspections at the reported site (see the report of the Área Rectora de Salud de Pococí).

On an undetermined date, CONAVI intervened in the area at issue in this constitutional protection proceeding (recurso de amparo), modifying a stormwater cutoff, which reduced the discharge of water into the receiving water body (cuerpo receptor) on the claimant’s property by 30% (see the report of the Área Rectora de Salud de Pococí).

Through official letter No. MS-DRRSHCP-ARSP-09891-2020 dated 30 de septiembre de 2020, the Área Rectora de Salud de Pococí issued a recommendation to the Municipalidad de Pococí in the following terms: “During the site visit, it was established that wastewater is indeed being discharged. Nevertheless, this is a general problem in the city of Guápiles, and resolving the situation requires political will on the part of AyA and the local government to arrange for the creation of a sanitary sewer system and thereby resolve the pollution problems affecting various water bodies that cross the city of Guápiles. Accordingly, it is important for the city of Guápiles to have a sanitary sewer system that enables wastewater to be collected and transported to a treatment and discharge point in compliance with the maximum permissible limits, in order to protect the community’s water resources (recurso hídrico). Please keep this Área Rectora de Salud informed of the actions taken” (see the evidence submitted by the Área Rectora de Salud de Pococí).

On 08 de julio de 2021, the ICAA conducted an inspection at the reported site, during which “the existence of a storm sewer extending to the property boundary could be observed. It was then observed that, beyond the storm sewer, open-channel surface runoff (escorrentía a cielo abierto) continues through the property from south to north” (see the ICAA report).

The wastewater treatment systems (sistemas de tratamiento de aguas residuales) for existing buildings are approved by the Ministerio de Salud and generally consist of septic tanks with drainage systems in areas without sanitary sewers; therefore, if it had considered such treatment inadequate, it should neither have approved it nor permitted the construction of buildings (see the ICAA report).

UNPROVEN FACTS. The following relevant facts are not deemed to have been duly established:

That the Municipalidad de Pococí provided the petitioner with a written response regarding the stormwater affecting the real property.

That the ICAA provided a written response to the request from the Municipalidad de Pococí regarding the construction of a sanitary sewer system.

That the respondent authorities (autoridades recurridas) made a coordinated decision regarding how to resolve the wastewater problem in the area at issue in this proceeding.

REGARDING THE RIGHT TO HEALTH AND TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT. The fundamental rights to health and to a healthy and ecologically balanced environment are constitutionally recognized (Articles 21, 50, 73 and 89 of the Constitución Política), as well as through the international rules applicable within the domestic legal system. In this regard, in Judgment No. 5928-06 at 15:00 hrs. on 2 de mayo de 2006, this Tribunal held as follows:

“(…) The right to life recognized in Article 21 of the Constitution is the cornerstone upon which the other fundamental rights of the inhabitants of the Republic rest. Likewise, the right to health is grounded in that provision of the political charter, since life is inconceivable unless individuals are guaranteed the minimum conditions necessary for an adequate and harmonious psychological, physical and environmental balance. Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in Articles 21, 50, 73 and 89 of the Constitución Política. Specifically, Article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of the foregoing, this Tribunal has employed the concept of ‘environmental quality’ as a measure of people’s quality of life, in conjunction with other elements such as health, food, work and housing, noting that every person has the right to use the environment for their own development, but not without limitation, because there is also a duty to protect and preserve the environment for present and future generations—the principle of sustainable development (principio de desarrollo sostenible) (…)”.

Likewise, the second paragraph of Article 50 of the Constitución Política establishes the State’s obligation to protect the environment. That provision states:

“(...) Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that violate that right and to seek redress for the harm caused (…)”.

This confirms that the various public authorities have an inescapable duty to preserve, defend and guarantee every person’s fundamental right to health and to a healthy and ecologically balanced environment.

ON THE PRINCIPLE OF COORDINATION IN ENVIRONMENTAL MATTERS. This Court has recognized that one of the guiding principles of administrative organization is coordination (coordinación), which must exist among all public entities and bodies when exercising their powers and providing the services assigned to them by the legal system. Thus, in Voto No. 3404-2005 at 18:29 hrs. on 29 de marzo de 2005, drafted by the Reporting Justice, this Chamber ruled as follows on the matter:

“(…) under the principle of coordination, the State is required to ensure that its entities adopt and implement all measures necessary to organize and harmonize their actions so that administrative management may be as expeditious and effective as possible for the benefit of the administered party (administrado). With regard to internal relations within an Administration, this principle refers to the various responsibilities that, in processing a matter from its initial submission through the final decision, fall to different departments, whether or not they are subject to a vertical hierarchical relationship with one another but, in all cases, belong to a single legal entity governed by public law. In such a situation, the various internal units of an entity responsible for developing and deciding specific sub-stages in the processing of applications submitted to it must coordinate with one another to ensure an agile and effective administrative proceeding (procedimiento administrativo) for the benefit of the citizen. If a delay in any such sub-stage causes an overall delay in the entire proceeding concerning an administrative claim, irrespective of the particular liability attributable to the body or department directly involved in the delay, the fact remains that the entity as such is likewise responsible for it (…)”.

Such administrative coordination takes on particular importance in cases involving environmental pollution, since it allows the various public entities and bodies to combine their efforts so that every person’s fundamental right to a healthy and ecologically balanced environment may be protected in a timely and effective manner.

V. ON THE COLLECTION, TREATMENT, AND FINAL DISPOSAL OF “SEWAGE” (AGUAS NEGRAS)

To effectively ensure the protection of a healthy and ecologically balanced environment, the State, understood in the broad sense, has a duty to provide the measures necessary to ensure that sewage receives timely and effective treatment in the country’s communities. In this regard, this Constitutional Court has held that ICAA, the Municipalities, and the Ministry of Health are each responsible—within their respective spheres of authority—for ensuring the proper collection, treatment, and final disposal of such wastewater. Thus, in the specific case of the Instituto Costarricense de Acueductos y Alcantarillados, its own Enabling Law (Ley Constitutiva)—Ley No. 2726 de 14 de abril de 1961 and its amendments—provides as follows:

“Article 1.- For the purpose of directing, setting policies, establishing and applying standards, carrying out and promoting the planning, financing, and development of, and resolving all matters related to, the supply of drinking water and the collection and conveyance of sewage and liquid industrial waste, as well as the regulation of storm-sewer systems in urban areas throughout the national territory, the Instituto Costarricense de Acueductos y Alcantarillados is hereby created as an autonomous State institution.” Accordingly, pursuant to Article 2° of that same body of law, that institution is responsible for: Directing and overseeing all matters relating to providing the inhabitants of the Republic with drinking-water services and services for the collection and conveyance of sewage, liquid industrial waste, and stormwater in urban areas. With respect to the Municipalities, it should be noted that Article 169 of the Political Constitution grants them authority to plan and oversee the urban development of their localities, as an extension of their obligation to administer local interests and services in each canton.

Consequently, each municipality is responsible for establishing a comprehensive urban-planning policy that guarantees development consistent with the efficient operation of a system for supplying drinking water and collecting, treating, and finally disposing of sewage. Likewise, the General Health Law (Ley General de Salud)—Ley No. 5395 de 30 de octubre de 1973—provides in Article 2° that the Executive Branch, through the Ministry of Health, is responsible for defining national health policy and for regulating, planning, and coordinating all public and private health-related activities, as well as performing those activities assigned to it by law. Similarly, Article 341 of the aforementioned law includes among the powers of the Ministry of Health the authority to order and take the special measures authorized by that legislation to prevent risks or harm to human health, prevent such risks or harm from spreading or worsening, and prevent private parties from continuing or repeating an infraction.

Regarding the specific matter at issue, the General Health Law, in Book 1, Title 3, Chapter 3, “Obligations and Restrictions Governing the Sanitary Disposal of Excreta and Wastewater,” provides, in pertinent part, as follows:

“Article 285.- Excreta, sewage, wastewater (aguas servidas), and stormwater shall be disposed of properly and hygienically in order to prevent contamination of the soil and natural water sources intended for human use and consumption, the creation of breeding grounds for disease vectors, and air pollution through conditions that jeopardize its purity or quality.” (Emphasis not in the original).

“Article 287.- Every natural or legal person who owns a dwelling, establishment, or building in which persons carry out their activities shall be responsible for ensuring that such property has a system for the disposal of excreta, sewage, and wastewater approved by the Ministry, and users of dwellings, establishments, or buildings shall be required to maintain that system in good operating condition.” “Article 288.- Every owner shall be required to connect the system for disposing of excreta, sewage, and wastewater from the owner’s property to the sanitary sewer system (alcantarillado sanitario) wherever such a system is in operation, except in those cases recognized as appropriate exceptions under the applicable regulations.” This legislation also establishes the obligation of the Ministry of Health authorities to ensure the application of and compliance with the provisions of that law and its regulations, without prejudice to the powers and obligations granted and imposed by special laws upon other public bodies or entities within their respective spheres of action (Article 337).

This confirms the various duties and obligations that the legal system imposes upon ICAA, the Ministry of Health, and the municipalities concerning the collection, treatment, and final disposal of sewage. Moreover, as noted in the preceding recital (considerando), these duties and obligations must be exercised in a coordinated manner to ensure administrative effectiveness and efficiency.

Regarding the specific case. After analyzing the reports and evidence submitted by the parties, this Chamber finds that the appellant’s fundamental rights were violated, for the reasons set forth below. In the case under consideration, the appellant alleged that he owns real property located in the province of Limón, canton of Poocí, district of Guápiles, and that his property is being adversely affected by the manner in which water flows onto it. It has been established that in 2020, the petitioner filed the following complaint with the Municipalidad de Pococí: “In that complaint, I explain that approximately in the year 2012, the Municipalidad de Pococi (sic), based on the fact that there had been a small stream (The (sic) small amount of water that entered the property disappeared when the lands located south of the property were developed), which entered through the southern part of the property and exited through the northern part.

The municipality channeled water collected from the sewer system in the southern area into the channel where the water from the small stream used to flow. I do not live in Guápiles, so I was unaware of the damage being caused to the property. Not only because of the amount of water that Enters and is eroding the land. But also because it is water contaminated with all kinds of substances. During my last visit to the property, I noticed that renovation work is being carried out on green areas south of the property, and it seems to me that this is where those waters should be connected to the culvert that was built last year in front of the cemetery. (west side of our property).” The Municipalidad de Pococí argued, however, that the municipal government did address the complaint, insofar as it notified the Ministry of Health and also sent a written communication to ICAA explaining the need to build a sanitary sewer system.

It further stated that all actions were communicated to the petitioner by email dated 15 de octubre de 2020. It was likewise stated that the water flowing through the area results from rainfall and the slope of the land, but that it is not, strictly speaking, a body of water. Thus, it argues that, pursuant to Article 20 of the General Public Roads Law (Ley General de Caminos Públicos), the lower-lying property is required to receive water from the roads. The evidence submitted by the respondent municipal corporation also includes official letter No. OCSM-311-2021 from the Departamento de Obras Civiles y Servicios Municipales de Pococí, which stated the following concerning stormwater: 1) Regarding the allegation that “the Municipality channeled water collected from the sewer system in the southern area into the channel where the water from a small stream used to flow,” it was stated that this description corresponds to the sewer systems of the developments known as “Los almendros” and “Llamas del Bosque,” which, at the time, channeled stormwater toward this area because it is the lowest point and the place through which stormwater naturally flowed.

Naturally, over the years, erosion has occurred and tends to increase the width of the channel. It was further stated that in the year 2017, because homes and streets in the area known as “Coopevigua 1,” located on the north side of this channel—that is, downstream from where the water exits Mr. Hasbun’s land—were being flooded, an intervention was undertaken to eliminate a portion amounting to at least 40% of the water being channeled onto the complainant’s land, and that water was diverted through a new storm sewer constructed by CONAVI at Dirección02, beside the complainant’s property. This storm sewer fills completely during periods of heavy rain, so it is not possible to divert water toward that area. Given this situation, Mr. Nombre01’s request to “connect the water to the culvert that was built last year in front of the cemetery” is not feasible; and 3) Given the existing topography and the situation described, it is not currently technically feasible to divert the stormwater to other nearby areas.

On the other hand, the Pococí Health Governing Area indicated that the central canton of Pococí faces a nationwide reality: it lacks a sanitary sewer system for wastewater treatment, and therefore homes, businesses, and industries discharge their wastewater into the curb and gutter. The environmental problem described herein was confirmed in the field, as no sanitary sewer network exists. Official letter MS-DRRSHC-ARSP-09891 was sent to the Mayor of Pococí so that he may take the appropriate action to provide the city of Guápiles with a sanitary sewer system that “allows wastewater to be collected and conveyed to a treatment and discharge point within the maximum permitted limits.” Lastly, the ICAA stated that:

  • 1)stormwater systems are administered by the Municipalities;
  • 2)a storm sewer was observed to exist and extend to the property boundary. It was then observed that, beyond the storm sewer, runoff (escorrentía) continues through an open channel running within the property;
  • 3)wastewater treatment systems for existing buildings are approved by the Ministry of Health and generally consist of septic tanks with drainage systems in areas where no sanitary sewer system exists; therefore, had it considered such treatment inadequate, it should neither have approved it nor permitted the construction of buildings;
  • 4)in the case of businesses and industries, the Ministry of Health also grants operating permits and must therefore ensure the proper treatment and disposal of the wastewater generated. In any event, it is empowered to issue health orders (órdenes sanitarias) to those engaging in such conduct, requiring them to correct it and use the approved treatment system;
  • 5)under the regulations in force, storm sewer systems are administered by the municipality of each canton, while the sanitary sewer system is operated and maintained by the operator responsible for providing drinking-water service within its respective geographic coverage area;
  • 6)where no sanitary sewer system exists, wastewater must be disposed of through individual systems, namely septic tanks together with their respective drainage systems;
  • 7)the ICAA has neither jurisdiction nor operational involvement in drinking-water or sanitation services or in the administration of the stormwater system because it is not the operator of those services;
  • 8)the ICAA has no administrative or operational involvement whatsoever at the location of the events, as it lies outside its geographic coverage area, and the operator of both the drinking-water system and the storm sewer system (rainwater) is necessarily the Municipalidad de Pococí.

In sum, based on the complaint filed by the petitioner and the reports submitted by the respondent parties, it may be concluded that the location at issue involves two matters: 1) rainwater (stormwater) and 2) wastewater or “sewage.” Accordingly, those matters will be decided separately in this amparo proceeding (recurso de amparo).

With regard to stormwater, it was established that the petitioner complained that a large volume of water enters his property, allegedly from the sewer system that the Municipalidad de Pococí channeled toward his property. However, as stated in official letter No. OCSM-311-2021 from the Pococí Department of Civil Works and Municipal Services, the petitioner’s request to “connect the water to the culvert that was built in front of the cemetery last year” is not feasible. It was likewise stated that diverting stormwater to other neighboring areas is currently infeasible. In addition, it was asserted that, pursuant to Article 20 of the Ley General de Caminos Públicos, the petitioner must receive the stormwater. Regarding this matter, the petitioner should be reminded that an amparo proceeding is inherently summary in nature—that is, brief and straightforward—and its processing is incompatible with lengthy and complex evidentiary proceedings or with the need first to determine—by way of declaratory relief—whether the rights below the constitutional level that the parties cite as part of the factual basis of the amparo proceeding or the legally required report (informe de ley), as applicable, actually exist. On this issue, judgment No. 2019002632, issued at 09:30 on 15 de febrero de 2019, held as follows:

“III.- REGARDING THE ALLEGED IRREGULAR DISCHARGE OF WATER ONTO THE PETITIONER’S PROPERTY. First, the petitioner alleges that stormwater and wastewater irregularly flow through his property and that the authorities of the respondent municipal corporation have not taken the steps necessary to address that problem, despite the requests submitted for that purpose. He claims that his property has gradually eroded and collapsed in certain areas, creating an enormous hazard, particularly during rainy periods when a greater volume of water flows through it. He further explains that, as the owner, he built an inspection chamber, purchased additional culverts, and planted grass in an effort to contain the damage, but obtained no positive results. Consequently, he requests that this Court, in view of the problem caused by an inadequate sewer system, order the respondents, among other measures, to eliminate the aforementioned passage of water through his property.

For their part, the authorities of the Municipalidad de Grecia reported under oath to this Chamber that, in order to address the problem complained of by the protected party, in 2017 he was informed that the drain running through his property could not be removed because doing so is legally prohibited; at the same time, he was provided with 30 24-inch culverts for installation on the aforementioned property. They also asserted that, since 2017, the petitioner had acknowledged before the municipality the existence and continued presence of the aforementioned water discharge. They further explained that this discharge is a water diversion originating from the public road and that it complies with section 20 of the Ley General de Caminos Públicos (Ley No. 5060 de 22 de agosto de 1972), which expressly provides as follows: “Article 20.- All possessors of real property, under any title, are required to receive and allow road runoff to flow through their properties whenever the slope of the terrain so requires; and when their properties are adjacent to a road’s drains, they must keep those drains clean, in perfect working condition, and free of obstructions.

The Ministry or the Municipalities shall order the work to be performed and shall charge the cost of the work plus a fifty percent (50%) surcharge if this obligation is not fulfilled. The Ministerio de Obras Públicas y Transportes and the Municipalities shall coordinate with the Ministerio de Agricultura regarding measures to protect roads in new-routing projects or maintenance work on existing roads in regions where such roads may cause or intensify erosion or divert the natural drainage of the fields.” The respondent authorities also reported that they inspected the sewer system and determined the following: “its condition is good, and the hydraulic cross-section has neither been reduced nor exhibits seepage or settlement.” Having reviewed those arguments, this Chamber finds that it lacks jurisdiction to determine whether, in this particular case—in light of the specific characteristics of the land—the protected party must bear the problem caused by the flow of water or whether the respondent municipality is responsible for addressing and definitively resolving it.

It should be noted that the petitioner claims that the volume of water is extremely high and has eroded his property to the point of causing subsidence; the respondents, on the other hand, without refuting that assertion, maintain that he must receive the water at issue pursuant to the aforementioned section 20 of the Ley General de Caminos Públicos. In essence, however, all of this concerns a dispute involving ordinary legality, the examination and resolution of which fall outside this Court’s jurisdiction. Disputes of this kind entail evidentiary and technical issues whose resolution exceeds the inherently summary nature of an amparo proceeding. In other words, it is neither materially nor reasonably possible in this proceeding to undertake a complicated and lengthy evidentiary process to analyze and determine which of the two parties is responsible for addressing the problem complained of.

Therefore, the petitioner, should he deem it appropriate, must submit the arguments at issue through the ordinary administrative or judicial legal channels established for that purpose (See, in a similar vein, this Chamber’s recent Judgment No. 2019-703, issued at 09:15 hrs. on 18 de enero de 2019).” Accordingly, pursuant to the cited precedent, it is not for this Constitutional Court, in this amparo proceeding, to determine whether, technically or under rules below the constitutional level, the petitioner must receive the stormwater or whether the Municipality must address and definitively resolve the matter. This is because doing so would entail undertaking a complicated and lengthy evidentiary process to analyze and determine which of the two parties is responsible for addressing the problem complained of. Therefore, the petitioner, should he deem it appropriate, must submit the arguments at issue through the ordinary administrative or judicial legal channels established for that purpose.

Nevertheless, the petitioner’s fundamental rights were violated insofar as, although he raised the problem he faces with stormwater, there is no evidence that the Municipalidad de Pococí issued a written decision on that issue. It should be noted that the respondent Administration conducted an inspection and issued an opinion concerning this matter—namely, official letter No. OCSM-311-2021 from the Department of Civil Works and Municipal Services—but there is no evidence that the complainant was informed of its contents. Consequently, with respect to this matter, the amparo proceeding must be granted solely as regards the failure to provide a written response.

In another vein, with regard to the issue of wastewater (aguas residuales) or “sewage (aguas negras),” the record shows that the appellant alleged that “he was unaware of the damage being caused to the property. Not only because of the amount of water entering and eroding the land, but also because it is water contaminated with all kinds of substances.” On this point, the Área Rectora de Salud de Pococí of the Ministerio de Salud stated that there is no sanitary sewer system (sistema de alcantarillado sanitario) for wastewater treatment anywhere in the central canton of Pococí, and therefore residences, businesses, and industries discharge their wastewater into the curb and gutter. That report stated that “the environmental problem is evident in the field.” According to that agency, the appropriate course of action was to construct a sanitary sewer system through coordination between the Municipalidad de Pococí and the ICAA.

The Municipalidad de Pococí also stated that it had referred the request for construction of the sanitary sewer system for Guápiles to the ICAA. Nevertheless, in its report, the respondent Institute questioned the role of the Ministerio de Salud in approving buildings, since it is legally required to approve wastewater treatment systems and has also failed to issue a series of health orders (órdenes sanitarias) to persons who discharge wastewater into the curb and gutter.

Regarding this issue, it bears reiterating that, in order to effectively fulfill the obligation to protect a healthy and ecologically balanced environment, the State, understood in the broad sense, has a duty to adopt the measures necessary to ensure the timely and effective treatment of wastewater or “sewage” in the country’s communities. In that regard, this Constitutional Court has held that the ICAA, the Municipalities, and the Ministerio de Salud are each responsible—within their respective spheres of authority—for ensuring the proper collection, treatment, and final disposal of such water. In the case under review (sub examine), the record shows that all three entities are aware of the situation, and there is no indication that a coordinated response to the problem exists. Of particular note is the position of the ICAA, which denies that it has any role in resolving the matter, even though the Municipalidad de Pococí had referred to it a request seeking support for the construction of a sanitary sewer system, with no indication that it even addressed the request so that a definitive response could be provided to the complainant.

On the other hand, the Chamber agrees with the ICAA that responsibility for this structural situation also lies with the Ministerio de Salud and the Municipalidad de Pococí, insofar as they have tolerated the discharge of wastewater into the storm sewer system (alcantarillado pluvial). Nor is there any indication that they have undertaken any proactive initiative—specifically the Municipality, in view of Article 169 of the Constitution—to implement a solution to the wastewater problem. In short, pursuant to the case law of this Constitutional Court, all three institutions are responsible for providing a solution to the wastewater problem, yet there is no reliable evidence of any proposal. It should be noted that the Municipality and the Ministerio de Salud state that the solution is the construction of a sanitary sewer system, whereas the ICAA maintains that, if no sanitary sewer system exists, wastewater must be disposed of through individual systems, namely septic tanks with their corresponding drainage systems. Accordingly, the appeal must be granted, with the consequences set forth in the operative portion of this judgment.

Partial dissenting opinion regarding the operative portion of this judgment by Justice Garro Vargas. Although I agree with the majority of the Chamber that the appeal should be granted, I disagree as to where the enforcement phase of the matter should be conducted with respect to the second order in the operative portion of this judgment, because the rules governing this constitutional jurisdiction do not provide adequate mechanisms for monitoring a judgment involving highly complex technical matters, as in this case, to ensure that the respondent authorities devise a definitive solution to the wastewater problem reported by the appellant on his property. By contrast, the provisions of the Código Procesal Contencioso-Administrativo governing enforcement (Article 155 et seq.) offer clear advantages, such as the ability to request schedules, impose fines, assign responsibility, oversee stages of compliance, and so forth. Therefore, pursuant to Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase should be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules of that Code.

Documentation submitted to the case file. This Chamber must advise the parties that, if they have submitted any paper documents, as well as objects or evidence stored on any additional device or on electronic, computer, magnetic, optical, or telematic media, or produced using new technologies, they must retrieve them from the court office within 30 business days after receiving notice of this judgment; otherwise, all such materials will be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial número 19 of 26 de enero del 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo del 2012, Article LXXXI.

Por tanto:

The appeal is granted. Consequently, the following are ordered: 1) Manuel Hernández Rivera, in his capacity as Alcalde de Pococí, or whoever holds that office in his stead, shall issue the orders and instructions within the scope of his authority so that the appellant is informed in writing of the decision concerning the complaint regarding the stormwater (aguas pluviales) problem, within five days from notice of this judgment; 2) Manuel Hernández Rivera, in his capacity as Alcalde, and Juan Luis Gómez Gómez, in his capacity as Presidente del Concejo, both of the Municipalidad de Pococí; Karen Mayorga Quirós, in her capacity as Directora del Área Rectora de Salud de Pococí; and Eric Alonso Bogantes Cabezas, in his capacity as Gerente General, and Miguel Antonio Badilla Ugalde, in his capacity as Jefe Cantonal de la Oficina de Pococí, both of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds those offices, shall, within ONE MONTH from notice of this judgment and in coordination with the appropriate authorities and entities, devise a definitive solution to the wastewater problem reported by the appellant on his property.

For this purpose, they shall establish a progress schedule, define the respective areas of authority, specify the administrative or technical measures required to meet the project’s objectives, designate those responsible for implementation and monitoring, and establish verification mechanisms. After establishing the deadlines for compliance, they shall begin implementation and shall also adopt interim measures to mitigate wastewater contamination on the appellant’s property. To this end, they shall notify the appellant of what has been agreed upon, namely, the decision concerning the definitive solution and the progress schedule. The respondent parties are warned that failure to comply with the aforementioned order will constitute the offense of disobedience and that, pursuant to Article 71 of the Ley de esta jurisdicción, any person who receives an order issued in an amparo proceeding (recurso de amparo) that the person must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The State, the Municipalidad de Pococí, and the Instituto Costarricense de Acueductos y Alcantarillados are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation jurisdiction. Justice Salazar Alvarado files a separate note. Justice Garro Vargas dissents with respect to enforcement of the second order of this judgment and directs that, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, enforcement be conducted before the Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules set forth in Article 155 et seq. of the Código Procesal Contencioso Administrativo. She further orders that a copy of the judgment be transmitted so that proceedings to enforce this ruling may commence. Notice shall be given.

NOTE BY JUSTICE SALAZAR ALVARADO. In environmental matters, it is also my view that, where the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative litigation jurisdiction. Nevertheless, I do address the merits when other rights of persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy environment free from contamination (Article 50 of the Constitución Política), as is the case here, where the appellant alleges that he reported that a large amount of water—purportedly originating from the sewer system that the Municipalidad de Pococí directed toward his property—enters his property and contains water contaminated with all types of substances, including sewage and wastewater, thereby violating the right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.

Recurso de amparo que se tramita en expediente número 21-011444-0007-CO, interpuesto por Nombre01, cédula de identidad CED01 , a favor de EMPRESA LIMÓN LUMBER COMPANY LIMITADA, contra LA MUNICIPALIDAD DE POCOCÍ, EL MINISTERIO DE SALUD Y EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).

Resultando

1. Por escrito recibido en la Secretaría de la Sala el 15 de junio de 2021, la parte recurrente interpone recurso de amparo contra la Municipalidad de Pococí, el Ministerio de Salud y el ICAA y manifiesta que la empresa amparada es propietaria registral de la Dirección01 ubicada en la provincia de Limón. Indica que desde el año 2020, su representada realizó una denuncia formal ante la Municipalidad de Pococí y también se le dio traslado al Ministerio de Salud. Señala que en la denuncia se expuso lo siguiente: "En dicha denuncia explico que la municipalidad de Pococi (sic) aproximadamente en el año 2012 basado en que existió una pequeña quebrada (La (sic) pequeña cantidad de agua que ingresaba desapareció de la propiedad cuando se urbanizaron los terrenos ubicados al sur de la propiedad), que ingresaba por la parte sur de la propiedad y salía de la misma por el norte. La municipalidad encausó aguas que se recogen del sistema de alcantarillado de la zona sur al cause por donde en el pasado corría el agua de la pequeña quebrada.

Yo no vivo en Guápiles, por lo que no tenía conocimiento de ese daño que se está causando a la propiedad. No solo por la cantidad de agua que Ingresa y está erosionando el terreno. También porque se trata de aguas contaminadas con toda clase de sustancias. En mi última visita a la propiedad noté que se están realizando trabajos de remodelación de zonas verdes al sur de la propiedad y me parece que es donde se deben de conectar esas aguas a la alcantarilla que el año pasado se construyó frente al cementerio. (costado oeste de nuestra propiedad)". Sin embargo, hasta el momento de la interposición de este recurso, no ha obtenido respuesta a su gestión, por parte de las autoridades recurridas. Afirma que la situación es muy agobiante, pues hay los malos olores y contaminación, que pueden generar enfermedades. Por las razones expuestas, estima lesionados los derechos fundamentales de la tutelada.

2. Por auto de las 13:58 horas del 16 de junio de 2021, la Presidencia de la Sala le confirió audiencia a la Municipalidad de Pococí y al Área Rectora de Salud de Pococí.

3. Informan bajo juramento Manuel Hernández Rivera, en su condición de Alcalde y Juan Luis Gómez Gómez, en su condición de Presidente del Concejo, ambos de la Municipalidad de Pococí, que la gestión sí fue atendida por el Departamento de Desarrollo y Control. Que la Municipalidad mostró ser diligente por medio de sus funcionarios, ya que, se dio parte al Ministerio de Salud y al ICAA exponiendo la necesidad de construir un alcantarillado sanitario para Guápiles, pues es una cuidad que ha tenido un crecimiento importante. Argumenta que es eso es competencia del ICAA. Las actuaciones fueron comunicadas al recurrente por medio del oficio No. DDCU-240-2020 del 15 de octubre de 2020. También indica que el agua que el sector es producto de las lluvias ante el desnivel del terreno y no se trata propiamente de un cuerpo de aguas, por lo que de conformidad con el artículo 20 de la Ley General de Caminos Públicos el predio inferior está en la obligación de recibir las aguas. Solicitan se declare sin lugar el recurso.

4. Informa bajo juramento Karen Mayorga Quirós, en su condición de Directora del Área Rectora de Salud de Pococí, que:

“PRIMERO: Que en nuestros archivos no aparece denuncia alguna por problemas de aguas residuales interpuesta por el aquí recurrente. SEGUNDO: Que en efecto contamos con la denuncia número consecutivo 302-2020, interpuesta por MINAE, vía correo electrónico (Código denuncia 18555-2020),donde “indica que, a causa del mal sistema de alcantarillado y contaminación del agua, se despiden fuertes olores”, sita frente al cementerio de Guápiles, en un lote sin construcción, plano número L-400398-1980. TERCERO: Que el cantón central de Pococí cuenta con una realidad país, de no tener un sistema de alcantarillado sanitario para tratamiento de aguas residuales, por lo que las viviendas, comercio e industrias desfogan sus aguas residuales al cordón y caño. CUARTO: Que, en la atención de la denuncia interpuesta líneas arriba, se realizaron las inspecciones de campo en coordinación con funcionarios municipales ambos del Departamento de Gestión Ambiental, y Departamento de Obras Civiles.

QUINTO: Que ambos funcionarios manifiestan que CONAVI intervino hace dos años dicho corte de agua pluviales, lo cual disminuyó en un 30% la descarga de aguas al cuerpo receptor de la propiedad del aquí recurrente. SEXTO: Que se evidencia en campo la problemática Ambiental aquí descrita pues no existe red de alcantarillado sanitario.( Informe Técnico MS-DRRSHC-ARSP-8965-2020). SÉTIMO: Que en vista de lo anterior se remite el oficio MS-DRRSHC-ARSP-09891 al Alcalde Municipal Señor Manuel Hernández Rivera para que tome las acciones del caso para que ciudad de Guápiles cuente con un sistema de alcantarillado sanitario, que “permita recolectar y transporte las aguas residuales hasta un punto de Tratamiento y vertido bajo los límites máximos permitidos”. Siendo competencia a través del artículo 169 como “Gobierno local”. OCTAVO: Que asimismo lo refieren en sus intervenciones los funcionarios municipales en sus sendos oficios UTGAM-591-2020, UTGAM-592-2020, detallando la descripción de lo evidenciado en el sitio, para mejor proveer.

NOVENO: Que según sus argumentos de lo expuesto se notificó oficio UTGAM-591- 2020 al Instituto Costarricense de Acueductos y Alcantarillados para lo pertinente como ente rector en materia de aguas residuales, tal y como lo legitima la normativa en su responsabilidad”.

5. Por resolución de las 09:05 horas del 05 de julio de 2021, la Magistrada Instructora amplió el auto de curso y le confirió audiencia al Gerente General y al Jefe de la Oficia de Pococí, ambos del ICAA.

6. El 09 de julio de 2021, el Magistrado Rueda Leal formuló solicitud de inhibitoria.

7. Por resolución de las 16:15 horas del 14 de julio de 2021, la Presidencia de la Sala aceptó la inhibitoria del Magistrado Rueda Leal.

8. Por concurso No. 9089 efectuado por la Presidencia de la Corte Suprema de Justicia, se designó como Magistrada suplente a Alicia María Salas Torres, en lugar del Magistrado Rueda Leal.

9. Informan bajo juramento Eric Alonso Bogantes Cabezas, en su condición de Gerente General y Miguel Antonio Badilla Ugalde, en su condición de Jefe Cantonal de la Oficina de Pococí, ambos del ICAA, que:

“El recurrente se queja por el ingreso de aguas pluviales a su propiedad que le ocasionan daños como erosión y por contaminación. Solicita a la Municipalidad, que esas aguas sean conectadas a una alcantarilla que se construyó frente al cementerio de Guápiles. En este punto, es importante indicar, que los sistemas pluviales son administrados y mantenidos por el municipio, por lo que AyA no tendría injerencia para atender esa primera solicitud. La propiedad a la que hace referencia el señor Nombre01, en calidad de recurrente (Folio real 4.718-000, con Plano Catastro L-0400398-1980, mide veintitrés mil seiscientos metros con setenta y cinco decímetros cuadrados, según información de certificación literal). En visita de campo, efectuada en compañía del Jefe Técnico, señor Marvin Pérez ( el 08 de Julio del 2021) se visualiza la existencia de un alcantarillado pluvial, que llega hasta el límite de la propiedad.

Luego se observa que, después del alcantarillado pluvial, continúa una escorrentía a cielo abierto que pasa por dentro de la propiedad, con dirección de sur a norte, según puede identificarse fácilmente, en la foto de GOOGLE, que se adjunta ( Prueba N° 4 ). Del informe emitido por la Directora del Área de Salud de Guápiles, se desprende que recibió una denuncia del MINAE donde se indica que a causa del mal estado del sistema de alcantarillado y contaminación del agua, se desprenden fuertes olores en una propiedad frente al cementerio de Guápiles. Alega que Guápiles no cuenta con un alcantarillado sanitario, por lo que las viviendas, comercios e industrias desfogan aguas residuales al cordón y caño. Al respecto, debe indicarse que los sistemas de tratamiento de aguas residuales para las construcciones existentes son aprobados por el Ministerio de Salud, siendo generalmente soluciones con tanques sépticos con drenajes en zonas donde no existe alcantarillado sanitario, de manera que si hubiera considerado que tal tratamiento no era el adecuado, no debió aprobarlo ni permitir la construcción de edificaciones.

En su informe, el Área de Salud de Guápiles indica que viviendas, comercios e industrias disponen sus aguas residuales al cordón y caño y no a los sistemas de tratamiento aprobados. En los casos de comercios e industrias ese Ministerio también otorga permisos de funcionamiento, por lo que debe asegurarse un adecuado tratamiento y disposición de las aguas residuales que se generen. En todo caso están facultados para emitir órdenes sanitarias a los que incurran en tales actos para que corrijan y utilicen el sistema de tratamiento aprobado. FINALMENTE ES IMPORTANTE INDICAR, QUE, EN LA CANTONAL DE POCOCÍ, NO EXISTE ALCANTARILLADO SANITARIO. SOBRE EL FONDO DEL ASUNTO Con respecto a lo indicado en el sentido de que : "( ) se notificó el oficio N° UTGAM-591- 2020 al Instituto Costarricense de Acueductos y Alcantarillados para lo pertinente como ente rector en materia de aguas residuales, tal y como lo legitima la normativa en su responsabilidad" es importante indicar que en la prueba que se aporta con el recurso no se adjunta ningún documento que demuestre lo anterior.

Sin perjuicio de lo anterior, la eventual responsabilidad en este caso no puede ni debe ser exigida a AyA, pues a la luz del principio de legalidad consagrado en el artículo 11 de la Constitución Política, y desarrollado también en el artículo 11 de la Ley General de la Administración Pública, se postula una forma especial de vinculación de las autoridades e instituciones públicas al ordenamiento jurídico, a partir de su definición básica según la cual toda autoridad o institución pública solamente puede actuar en la medida en que se encuentre apoderada para hacerlo por el mismo ordenamiento, y normalmente a texto expreso para las autoridades e instituciones públicas sólo está permitido lo que esté constitucional y legalmente autorizado en forma expresa, y todo lo que no les esté autorizado les está vedado. En Costa Rica existen dos sistemas de alcantarillado separados, uno denominado “sistema de alcantarillado pluvial” cuyo objetivo es transportar las aguas de lluvia provenientes de techos, canoas y bajantes de las viviendas, así como las aguas de lluvia que discurren por las vías públicas, y el otro sistema se denomina “sistema de alcantarillado sanitario” cuyo objetivo es transportar únicamente las aguas residuales provenientes de pilas, fregaderos, duchas e inodoros que se generan a lo interno de las viviendas.

De acuerdo con la reglamentación vigente, los sistemas de alcantarillado pluvial son administrados por las municipalidades de cada cantón y el sistema de alcantarillado sanitario es operado y mantenido por el operador a cargo de prestar el servicio de agua potable dentro de su respectiva área geográfica de cobertura. En caso de no existir sistema de alcantarillado sanitario, la disposición de las aguas residuales debe realizarse mediante sistemas individuales a saber, tanques sépticos más su respectivo drenaje. El sistema de alcantarillado pluvial, llámese canal natural, acequia o cualquiera otra denominación que se le quiera dar, debe ser administrado y por ende mantenido operando adecuadamente por la municipalidad de cada cantón. El Instituto Costarricense de Acueductos y Alcantarillados ( AyA ) no tiene competencia ni injerencia operativa en los servicios a agua potable, de saneamiento ni de administración del sistema pluvial, por no ser el operador de esos servicios.

En sentido señala el artículo 1 de la Ley de Construcciones ( N° 833) : "Las Municipalidades de la República son las encargadas de que las ciudades y demás poblaciones reúnan las condiciones necesarias de seguridad, salubridad, comodidad y belleza en sus vías públicas y en los edificios y construcciones que en terrenos de estas se levanten sin perjuicio de las facultades que las leyes les concedan en estas materias a otros órganos administrativos". La Ley para la Gestión Integral de Residuos (N° 88339) regula en su artículo 8 lo concerniente a las funciones de las municipalidades, y; señala claramente que éstas serán responsables de la gestión integral de los residuos generados en su cantón. Por su parte la Ley General de Salud dispone: ARTÍCULO 292.--Queda prohibido en todo caso la descarga de las aguas negras, de las aguas servidas y de residuos industriales al alcantarillado pluvial. El Ministerio queda facultado para restringir, regular, o prohibir la eliminación de productos sintéticos no biodegradables a través de los sistemas de recolección de excretas, aguas negras y servidas.

ARTÍCULO 285.--Las excretas, las aguas negras, las servidas y las pluviales, deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad. Conforme con lo anterior, reiteramos que AyA no tiene ninguna injerencia administrativa ni operativa en el lugar de los hechos, siendo que se encuentra fuera de su ubicación de cobertura geográfica y el operador tanto del sistema de agua potable, como del sistema de alcantarillado pluvial (aguas de lluvia) indefectiblemente es la Municipalidad”.

10. En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrado Castillo Víquez; y,

Considerando:

I. OBJETO DEL RECURSO

El recurrente reclama la vulneración a sus derechos fundamentales, pues acusa que la empresa amparada es propietaria registral de la finca número 4718 ubicada en la provincia de Limón. Indica que desde el año 2020, su representada realizó una denuncia formal ante la Municipalidad de Pococí y también se le dio traslado al Ministerio de Salud. Señala que en la denuncia se expuso lo siguiente: "En dicha denuncia explico que la municipalidad de Pococi (sic) aproximadamente en el año 2012 basado en que existió una pequeña quebrada (La (sic) pequeña cantidad de agua que ingresaba desapareció de la propiedad cuando se urbanizaron los terrenos ubicados al sur de la propiedad), que ingresaba por la parte sur de la propiedad y salía de la misma por el norte. La municipalidad encausó aguas que se recogen del sistema de alcantarillado de la zona sur al cause por donde en el pasado corría el agua de la pequeña quebrada.

Yo no vivo en Guápiles, por lo que no tenía conocimiento de ese daño que se está causando a la propiedad. No solo por la cantidad de agua que Ingresa y está erosionando el terreno. También porque se trata de aguas contaminadas con toda clase de sustancias. En mi última visita a la propiedad noté que se están realizando trabajos de remodelación de zonas verdes al sur de la propiedad y me parece que es donde se deben de conectar esas aguas a la alcantarilla que el año pasado se construyó frente al cementerio. (costado oeste de nuestra propiedad)". Sin embargo, hasta el momento de la interposición de este recurso, no ha obtenido respuesta a su gestión, por parte de las autoridades recurridas. Afirma que la situación es muy agobiante, pues hay los malos olores y contaminación, que pueden generar enfermedades.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la parte recurrida haya omitido referirse a ellos según lo prevenido en el auto inicial:

La parte recurrente es propietaria de un bien inmueble en la provincia de Limón, cantón de Pococí, distrito de Guápiles (hecho no controvertido).

El cantón central de Pococí no cuenta con un sistema de alcantarillado sanitario para el tratamiento de aguas sanitarias, por lo que las viviendas, comercio e industrias desfogan sus aguas residuales al cordón y caño (véase el informe del Área Rectora de Salud de Pococí).

En Costa Rica existen dos sistemas de alcantarillado separados, uno denominado “Sistema de Alcantarillado Pluvial” cuyo objetivo es transportar las aguas de lluvia provenientes de techos, canoas y bajantes de las viviendas, así como las aguas de lluvia que discurren por las vías públicas, y el otro sistema se denomina “Sistema de Alcantarillado Sanitario” cuyo objetivo es transportar únicamente las aguas residuales provenientes de pilas, fregaderos, duchas e inodoros que se generan a lo interno de las viviendas. De acuerdo con la reglamentación vigente, los sistemas de alcantarillado pluvial son administrados por las municipalidades de cada cantón y el sistema de alcantarillado sanitario es operado y mantenido por el operador a cargo de prestar el servicio de agua potable dentro de su respectiva área geográfica de cobertura (véase el informe del ICAA).

En 2020, la parte recurrente denunció ante la Municipalidad En dicha denuncia explico que la municipalidad de Pococi (sic) aproximadamente en el año 2012 basado en que existió una pequeña quebrada (La (sic) pequeña cantidad de agua que ingresaba desapareció de la propiedad cuando se urbanizaron los terrenos ubicados al sur de la propiedad), que ingresaba por la parte sur de la propiedad y salía de la misma por el norte. La municipalidad encausó aguas que se recogen del sistema de alcantarillado de la zona sur al cause por donde en el pasado corría el agua de la pequeña quebrada. Yo no vivo en Guápiles, por lo que no tenía conocimiento de ese daño que se está causando a la propiedad. No solo por la cantidad de agua que Ingresa y está erosionando el terreno. También porque se trata de aguas contaminadas con toda clase de sustancias. En mi última visita a la propiedad noté que se están realizando trabajos de remodelación de zonas verdes al sur de la propiedad y me parece que es donde se deben de conectar esas aguas a la alcantarilla que el año pasado se construyó frente al cementerio. (costado oeste de nuestra propiedad)" (hecho no controvertido).

En fecha indeterminada, la Municipalidad de Pococí realizó una inspección en el lugar denunciado y determinó que “este tipo de problemática es muy compleja de atender por la gran cantidad de vertidos ilegales de aguas residuales que se disponen en el alcantarillado pluvial, máxime las aguas que afectan la propiedad en cuestión proviene de distintas urbanizaciones (Los Almendros, Llamas del Bosque y Urbanización Toro Amarillo), esta situación es una evidente consecuencia de la falta de alcantarillado sanitario en Guápiles” (véase la prueba aportada por la Municipalidad de Pococí).

El 17 de septiembre de 2020, la Municipalidad de Pococí mediante oficio No. UTGAM-592-2020 le expuso la necesidad al ICAA iniciar con los estudios pertinentes para lograr la construcción de un alcantarillado sanitario para la ciudad de Guápiles. En dicho traslado, se consignó lo siguiente: “Reciba un cordial saludo de la Unidad Técnica de Gestión Ambiental Municipal (UTGAM), de la Municipalidad de Pococí, sirva la presente para informarle que el pasado 11 de setiembre de año en curso, se realizó la atención de la denuncia ingresada mediante el Sistema Integrado de Trámite y Atención de Denuncias Ambientales, misma bajo el número SITADA-18555-2019. Esta atención se realiza de forma interinstitucional, en la cual participa la Licda. Ana Morales del Área Rectora de Salud de Pococí, Ministerio de Salud, el Ing. Brandon Agüero, de la Unidad de Obras Civiles, y mi persona en representación de la UTGAM.

La denuncia fue interpuesta por el señor Nombre02, por motivo de mal sistema de alcantarillado y contaminación de agua, esto con dirección en un predio ubicado al costado este del Cementerio de Guápiles. Se hace mención que el señor Nombre01 se encuentra denunciando una situación que lamentablemente es una realidad en la mayoría de las ciudades del Costa Rica, ésta es la contaminación de los cuerpos de agua que atraviesan los centros poblacionales y que reciben altas cargas de aguas residuales. La Licda. Morales manifiesta que este tipo de problemática es muy compleja de atender por la gran cantidad de vertidos ilegales de aguas residuales que se disponen en el alcantarillado pluvial, añade que esta situación deviene de la falta de alcantarillado sanitario en Guápiles. La denuncia SITADA-18555-2019, expone una problemática que será cada vez más creciente en Pococí, misma que debe comenzar a atenderse de forma interinstitucional, para lograr a mediano o largo plazo contar con un alcantarillado sanitario que brinde tratamiento ambientalmente responsable de las aguas residuales que se generan por la población.

Por lo mencionado se remite la presente al Instituto Costarricense de Acueductos y Alcantarillados, para hacer manifiesta la necesidad de iniciar con los estudios pertinentes para lograr a futuro la construcción de un alcantarillado sanitario para la ciudad de Guápiles. Manifestamos que, por parte de la UTGAM, nos encontramos en la anuencia de participar en las gestiones que sean necesarias para llevar con éxito éste proyecto de gran importancia para nuestro cantón” (véase la prueba aportada por la Municipalidad de Pococí).

De conformidad con el oficio No. OSCM-311-2021 emitido por el Departamento de Obras Civiles y Servicios Municipales de Pococí, se indicó que: “el señor Nombre03 menciona en su denuncia, que en su finca ´existió una pequeña quebrada, con aguas que ingresaban por la parte sur de la propiedad, y luego salía hacia el norte´. Este cuerpo de agua que menciona el sr. Nombre03 corresponde con una depresión natural por la que discurren aguas de lluvia, esto debido a que, según la topografía existente en los terrenos aledaños, las aguas fluyen hacia ese sector” (véase la prueba aportada por la Municipalidad de Pococí).

De conformidad con el oficio No. OSCM-311-2021 emitido por el Departamento de Obras Civiles y Servicios Municipales de Pococí, se indicó que: “la Municipalidad encausó aguas que recogen del sistema de alcantarillado de la zona sur del cause por donde en el pasado corría el agua de una pequeña quebrada; esta descripción corresponde con sistemas de alcantarillado de las urbanizaciones conocidas como ´Los almendros´ y ´Llamas del Bosque´; las cuales en su momento canalizaron las aguas de lluvia hacia este sector, ya que corresponde con el punto más bajo y por donde naturalmente discurrían las aguas de lluvia. Naturalmente, con el paso de los años, se ha ocasionado una erosión que tiende a aumentar el ancho del canal” (véase la prueba aportada por la Municipalidad de Pococí).

De conformidad con el oficio No. OSCM-311-2021 emitido por el Departamento de Obras Civiles y Servicios Municipales de Pococí, se indicó que: “En el año 2017, debido a situaciones de anegamiento de viviendas y calles que se producían en el sector conocido como “Coopevigua 1” ubicado al costado norte de este canal, es decir, después de la salida de las aguas del terreno del señor Hasbun; se realizó una intervención para eliminar una porción de al menos un 40% de las aguas que se encausaban al terreno del denunciante, y se desviaron a través de un alcantarillado nuevo que construyó CONAVI en la Dirección02, a un costado de la propiedad del denunciante. Este alcantarillado pluvial se llena completamente en periodos de lluvia fuerte, por lo que no existe posibilidad de desviar aguas hacia ese sector. Dada esta situación, la solicitud del señor Nombre01 de ´conectar las aguas a la alcantarilla que el año pasado se construyó frente al cementerio´ no es factible” (véase la prueba aportada por la Municipalidad de Pococí).

La parte recurrente no ha presentado ninguna denuncia ante el Área Rectora de Salud de Pococí denunciando la problemática de aguas residuales (véase el informe del Área Rectora de Salud de Pococí).

El Área Rectora de Salud de Pococí cuenta con la denuncia número consecutivo 302-2020, interpuesta por el Ministerio de Ambiente y Energía, vía correo electrónico (código denuncia 18555-2020) donde se “indica que, a causa del mal sistema de alcantarillado y contaminación del agua, se despiden fuertes olores, sita frente al cementerio de Guápiles, en un lote sin construcción, plano número L-400398-1980” (véase el informe del Área Rectora de Salud de Pococí).

En atención a la denuncia interpuesta por el MINAE, el Área Rectora de Salud y la Municipalidad de Pococí realizaron inspecciones en el lugar denunciado (véase el informe del Área Rectora de Salud de Pococí).

En fecha indeterminada, el CONAVI intervino en la zona objeto de este recurso de amparo y se intervino un corte de aguas pluviales, lo cual disminuyó un 30% la descarga de aguas al cuerpo receptor de la propiedad del accionante (véase el informe del Área Rectora de Salud de Pococí).

Por oficio No. MS-DRRSHCP-ARSP-09891-2020 del 30 de septiembre de 2020, el Área Rectora de Salud de Pococí emitió una recomendación a la Municipalidad de Pococí, en los siguientes términos: “En la vista se logró comprobar que, efectivamente existe descarga de aguas residuales, no obstante, este ámbito es una problemática general de la ciudad de Guápiles, para lo cual para solventar la situación debe existir voluntad política por parte de AyA y Gobierno local para que se gestione la creación del sistema de alcantarillado sanitario y así solventar problemas de contaminación de diversos cuerpos de agua que atraviesan la ciudad de Guápiles. Por lo anterior, es importante que la ciudad de Guápiles cuente con un sistema de alcantarillado sanitario, que permita recolectar y transportar las aguas residuales hasta un punto de tratamiento y vertido bajo los límites máximos permisibles, en aras de proteger el recurso hídrico de la comunidad. Favor mantener a esta Área Rectora de Salud informada sobre las gestiones realizadas” (véase la prueba aportada del Área Rectora de Salud de Pococí).

El 08 de julio de 2021, el ICAA realizó una inspección en el lugar denunciado y que “se visualiza la existencia de un alcantarillado pluvial, que llega hasta el límite de la propiedad. Luego se observa que, después del alcantarillado pluvial, continúa una escorrentía a cielo abierto que pasa por dentro de la propiedad, con dirección de sur a norte” (véase el informe del ICAA).

Los sistemas de tratamiento de aguas residuales para las construcciones existentes son aprobados por el Ministerio de Salud, siendo generalmente soluciones con tanques sépticos con drenajes en zonas donde no existe alcantarillado sanitario, de manera que si hubiera considerado que tal tratamiento no era el adecuado, no debió aprobarlo ni permitir la construcción de edificaciones (véase el informe del ICAA).

HECHOS NO PROBADOS. No se estiman como debidamente demostrados los siguientes hechos de relevancia:

Que la Municipalidad de Pococí le haya resuelto por escrito a la parte recurrente en relación con el tema de las aguas pluviales que soporta el bien inmueble.

Que el ICAA haya atendido por escrito la solicitud de la Municipalidad de Pococí en relación con la construcción de un alcantarillado sanitario.

Que las autoridades recurridas hayan de forma coordinada tomado una decisión de como solventar la problemática de aguas residuales en la zona objeto del recurso.

SOBRE EL DERECHO A LA SALUD Y A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO. Los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Constitución Política), así como a través de la normativa internacional aplicable al ordenamiento interno. En este sentido, en Sentencia No. 5928-06 de las 15:00 hrs. de 2 de mayo de 2006, este Tribunal estimó lo siguiente:

“(…) El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental. Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública.

En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de “calidad ambiental” como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras –principio de desarrollo sostenible (…)”.

Asimismo, del segundo párrafo del artículo 50 de la Constitución Política se deriva la obligación del Estado de proteger el ambiente. Norma que establece al efecto:

"(...) Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado (…)”.

Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado.

ACERCA DEL PRINCIPIO DE COORDINACIÓN EN MATERIA AMBIENTAL. Este Tribunal ha reconocido que uno de los principios rectores de la organización administrativa lo constituye la coordinación que debe mediar entre todos los entes y órganos públicos al ejercer sus competencias y prestar los servicios que el ordenamiento jurídico les ha asignado. Así, esta Sala, en el Voto No. 3404-2005 de las 18:29 hrs. de 29 de marzo de 2005, con redacción del Magistrado ponente, dispuso, sobre el particular, lo siguiente:

“(…) según el principio de coordinación, el Estado está obligado a que sus entidades adopten e implementen todas aquellas medidas requeridas para organizar y armonizar sus actuaciones para que la gestión administrativa sea lo más célere y efectiva posible en beneficio del administrado. En lo que concierne a las relaciones internas dentro de una Administración, ese principio se refiere a las diversas responsabilidades que en la tramitación de un asunto, desde su planteamiento inicial hasta la decisión definitiva, corresponden a diferentes departamentos, sujetos o no a una relación vertical de jerarquía entre sí pero, en todo caso, pertenecientes a una única persona jurídica de derecho público. En tal situación, las diversas dependencias internas de una entidad, responsables de gestar y decidir determinadas sub-etapas para la tramitación de las gestiones ante ella presentadas, deben coordinar entre sí a efectos de procurar un procedimiento administrativo ágil y efectivo en provecho del ciudadano. Si por un atraso en alguna de tales sub-etapas se produce un retardo general de toda el procedimiento relativo a un reclamo administrativo, independientemente de la responsabilidad particular que le incumba al órgano o departamento involucrado directamente en la demora acaecida, lo cierto es que la entidad como tal resulta igualmente responsable de la misma (…)”.

Dicha coordinación administrativa adquiere particular relevancia en el caso de problemas de contaminación ambiental, ya que, ésta permite que los distintos entes y órganos públicos puedan conjuntar esfuerzos, para que, se pueda proteger, de forma oportuna y efectiva, el derecho fundamental de toda persona a un ambiente sano y ecológicamente equilibrado.

V. SOBRE LA RECOLECCIÓN, TRATAMIENTO Y DISPOSICIÓN FINAL DE LAS “AGUAS NEGRAS”

Para cumplir, efectivamente, con la protección a un ambiente sano y ecológicamente equilibrado, el Estado, entendido en sentido amplio, está en el deber de disponer de las medidas necesarias para que en las comunidades del país se brinde tratamiento oportuno y efectivo a las aguas negras. En ese sentido, este Tribunal Constitucional ha sido del criterio que, tanto al ICAA, como a las Municipalidades y al Ministerio de Salud, les corresponde -dentro de sus respectivos ámbitos de competencia-, velar por la debida recolección, tratamiento y disposición final de tales aguas. Así, en el caso específico del Instituto Costarricense de Acueductos y Alcantarillados, su propia Ley Constitutiva -Ley No. 2726 de 14 de abril de 1961 y sus reformas-, dispone lo siguiente:

“ Artículo 1.- Con el objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable y recolección y evacuación de aguas negras y residuos industriales líquidos, lo mismo que el aspecto normativo de los sistemas de alcantarillado pluvial en áreas urbanas, para todo el territorio nacional se crea el Instituto Costarricense de Acueductos y Alcantarillados, como institución autónoma del Estado.” Por lo que a dicha institución le corresponde, conforme a lo dispuesto en el artículo 2° de ese mismo cuerpo normativo: Dirigir y vigilar todo lo concerniente para proveer a los habitantes de la república de un servicio de agua potable, recolección y evacuación de aguas negras y residuos industriales líquidos y de aguas pluviales en las áreas urbanas. En lo referente a las Municipalidades, debe indicarse que el artículo 169 de la Constitución Política le otorga a éstas la competencia para planificar y vigilar el desarrollo urbano de su localidad, como derivación de su obligación de administrar los intereses y servicios locales en cada cantón.

En razón de lo anterior, corresponde a cada municipio establecer una política integral de planteamiento urbano, que garantice un desarrollo en congruencia con el funcionamiento eficiente de un sistema de provisión de agua potable y de recolección, tratamiento y disposición final de las aguas negras. De igual forma, la Ley General de Salud -Ley No. 5395 de 30 de octubre de 1973-, dispone, en su artículo 2°, que le corresponde al Poder Ejecutivo, a través del Ministerio de Salud, la definición de la política nacional de salud, la normación, planificación y coordinación de todas las actividades públicas y privadas relativas a salud, así como la ejecución de aquellas actividades que le competen conforme a la ley. De igual forma, el artículo 341 de la referida ley establece, dentro de las atribuciones del Ministerio de Salud, la de ordenar y tomar las medidas especiales que habilita esa normativa para evitar el riesgo o daño a la salud de las personas o que éstos se difundan o se agraven y para inhibir la continuación o reincidencia en la infracción de los particulares.

En cuanto al tema específico, la Ley General de Salud, en su Libro 1, Título 3, Capítulo 3, “De las obligaciones y restricciones para la evacuación sanitaria de excretas y aguas servidas”, dispone -en lo conducente-, lo siguiente:

“Artículo 285.- Las excretas, las aguas negras , las servidas y las pluviales, deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad.” (El destacado no forma parte del original).

“ Artículo 287.- Toda persona, natural o jurídica, propietaria de viviendas o de establecimientos o edificios en que las personas desarrollen sus actividades, responderá de que tales bienes dispongan de un sistema de disposición de excretas y de aguas negras y servidas aprobado por el Ministerio y los usuarios de viviendas, establecimientos o edificios estarán obligados a mantener dicho sistema en buenas condiciones de funcionamiento.” “ Artículo 288.- Todo propietario queda obligado a conectar el sistema de eliminación de excretas de aguas negras y servidas de su propiedad al alcantarillado sanitario en los lugares en que éste estuviera en funcionamiento, salvo en los casos de excepción que los reglamentos pertinentes reconozcan como procedentes.” Asimismo, de dicha normativa se colige la obligación de las autoridades del Ministerio de Salud de velar por la aplicación y el control del cumplimiento de las disposiciones de esa ley y de su reglamentación, sin perjuicio de las facultades y obligaciones que leyes especiales otorguen e impongan a otros órganos o entes públicos dentro de sus respectivos campos de acción (artículo 337).

Se corrobora, así, las distintas funciones y obligaciones que el ordenamiento jurídico le impone al ICAA, al Ministerio de Salud y a las municipalidades, en materia de recolección, tratamiento y disposición final de las aguas negras. Funciones y obligaciones que, además -y como ya se adelantó en el considerando anterior-, se deben ejercer de forma coordinada, para asegurar así la eficacia y eficiencia administrativa.

Sobre el caso concreto. Después de haber analizado los informes y las pruebas aportadas por las partes, esta Sala verifica la vulneración a los derechos fundamentales de la parte recurrente, por las razones que a continuación serán expuestas. Para el caso bajo estudio, el recurrente reclamó que es propietario de un bien inmueble ubicado en la provincia de Limón, cantón de Poocí, distrito de Guápiles y que está sufriendo de afectaciones por la forma en que recibe el agua su propiedad. Se verifica que en 2020, el accionante denunció ante la Municipalidad de Pococí lo siguiente: "En dicha denuncia explico que la municipalidad de Pococi (sic) aproximadamente en el año 2012 basado en que existió una pequeña quebrada (La (sic) pequeña cantidad de agua que ingresaba desapareció de la propiedad cuando se urbanizaron los terrenos ubicados al sur de la propiedad), que ingresaba por la parte sur de la propiedad y salía de la misma por el norte.

La municipalidad encausó aguas que se recogen del sistema de alcantarillado de la zona sur al cause por donde en el pasado corría el agua de la pequeña quebrada. Yo no vivo en Guápiles, por lo que no tenía conocimiento de ese daño que se está causando a la propiedad. No solo por la cantidad de agua que Ingresa y está erosionando el terreno. También porque se trata de aguas contaminadas con toda clase de sustancias. En mi última visita a la propiedad noté que se están realizando trabajos de remodelación de zonas verdes al sur de la propiedad y me parece que es donde se deben de conectar esas aguas a la alcantarilla que el año pasado se construyó frente al cementerio. (costado oeste de nuestra propiedad)".

Ahora bien, la Municipalidad de Pococí alegó que el gobierno municipal sí atendió la denuncia, en el tanto se le dio parte al Ministerio de Salud y que también dirigió un escrito al ICAA exponiendo la necesidad de construir un alcantarillado sanitario. Además, que todas las actuaciones se le comunicaron al accionante mediante correo electrónico del 15 de octubre de 2020. Igualmente, se indicó que el agua que recorre el sector es producto de las lluvias ante el desnivel del terreno, pero que no se trata propiamente de un cuerpo de agua. Así, alega que de conformidad con el artículo 20 de la Ley General de Caminos Públicos el predio inferior está en la obligación de recibir el agua de los caminos. También, de la prueba aportada por esa corporación recurrida, consta el oficio No. OCSM-311-2021 del Departamento de Obras Civiles y Servicios Municipales de Pococí, en el que se indicó -en relación con las aguas de lluvia- que: 1) respecto al alegato de que “la Municipalidad encausó aguas que recogen del sistema de alcantarillado de la zona sur del cause por donde en el pasado corría el agua de una pequeña quebrada”.

Se señaló que esta descripción corresponde con sistemas de alcantarillado de las urbanizaciones conocidas como “Los almendros” y “Llamas del Bosque”; las cuales en su momento canalizaron las aguas de lluvia hacia este sector, ya que corresponde con el punto más bajo y por donde naturalmente discurrían las aguas de lluvia. Naturalmente, con el paso de los años, se ha ocasionado una erosión que tiende a aumentar el ancho del canal. Además, se indicó que en el año 2017, debido a situaciones de anegamiento de viviendas y calles que se producían en el sector conocido como “Coopevigua 1” ubicado al costado norte de este canal, es decir, después de la salida de las aguas del terreno del señor Hasbun; se realizó una intervención para eliminar una porción de al menos un 40% de las aguas que se encausaban al terreno del denunciante, y se desviaron a través de un alcantarillado nuevo que construyó CONAVI en la Dirección02, a un costado de la propiedad del denunciante.

Este alcantarillado pluvial se llena completamente en periodos de lluvia fuerte, por lo que no existe posibilidad de desviar aguas hacia ese sector. Dada esta situación, la solicitud del señor Nombre01 de “conectar las aguas a la alcantarilla que el año pasado se construyó frente al cementerio” no es factible; y, 3) Dada la topografía existente y la situación descrita, actualmente no es factible técnicamente desviar las aguas pluviales a otros sectores aledaños.

Por otro lado, el Área Rectora de Salud de Pococí indicó que en el cantón central de Pococí cuenta con una realidad país, de no tener un sistema de alcantarillado sanitario para tratamiento de aguas residuales, por lo que las viviendas, comercio e industrias desfogan sus aguas residuales al cordón y caño. Que se evidenció en campo la problemática ambiental aquí descrita pues no existe red de alcantarillado sanitario. Que se remitió el oficio MS-DRRSHC-ARSP-09891 al Alcalde de Pococí para que tome las acciones del caso para que ciudad de Guápiles cuente con un sistema de alcantarillado sanitario, que “permita recolectar y transporte las aguas residuales hasta un punto de Tratamiento y vertido bajo los límites máximos permitidos”.

Por último, el ICAA señaló que:

  • 1)los sistemas pluviales son administrados por las Municipalidades;
  • 2)Que se visualiza la existencia de un alcantarillado pluvial, que llega hasta el límite de la propiedad Luego se observa que, después del alcantarillado pluvial, continúa una escorrentía a cielo abierto que pasa por dentro de la propiedad;
  • 3)Los sistemas de tratamiento de aguas residuales para las construcciones existentes son aprobados por el Ministerio de Salud, siendo generalmente soluciones con tanques sépticos con drenajes en zonas donde no existe alcantarillado sanitario, de manera que si hubiera considerado que tal tratamiento no era el adecuado, no debió aprobarlo ni permitir la construcción de edificaciones;
  • 4)En los casos de comercios e industrias el Ministerio de Salud también otorga permisos de funcionamiento, por lo que debe asegurarse un adecuado tratamiento y disposición de las aguas residuales que se generen. En todo caso están facultados para emitir órdenes sanitarias a los que incurran en tales actos para que corrijan y utilicen el sistema de tratamiento aprobado;
  • 5)De acuerdo con la reglamentación vigente, los sistemas de alcantarillado pluvial son administrados por las municipalidades de cada cantón y el sistema de alcantarillado sanitario es operado y mantenido por el operador a cargo de prestar el servicio de agua potable dentro de su respectiva área geográfica de cobertura;
  • 6)En caso de no existir sistema de alcantarillado sanitario, la disposición de las aguas residuales debe realizarse mediante sistemas individuales a saber, tanques sépticos más su respectivo drenaje;
  • 7)El ICAA no tiene competencia ni injerencia operativa en los servicios a agua potable, de saneamiento ni de administración del sistema pluvial, por no ser el operador de esos servicios;
  • 8)Que el ICAA no tiene ninguna injerencia administrativa ni operativa en el lugar de los hechos, siendo que se encuentra fuera de su ubicación de cobertura geográfica y el operador tanto del sistema de agua potable, como del sistema de alcantarillado pluvial (aguas de lluvia) indefectiblemente es la Municipalidad de Pococí.

En fin, de conformidad con la denuncia planteada por la parte recurrente y lo informado por las partes recurridas, se logra desprender que en el sitio en cuestión hay dos extremos: 1) el tema de las aguas de lluvia (aguas pluviales) y 2) las aguas residuales o “aguas negras”. Así las cosas, en este recurso, esos puntos serán resueltos de forma independiente.

En lo que respecta al tema de las aguas pluviales. Se logró desprender que el recurrente denunció que a su propiedad ingresa mucha agua proveniente supuestamente del sistema de alcantarillado que la Municipalidad de Pococí encausó hacia su propiedad. Ahora, tal como constó en el oficio No. OCSM-311-2021 del Departamento de Obras Civiles y Servicios Municipales de Pococí se indicó que la solicitud del recurrente para “conectar las aguas a la alcantarilla que en el año pasado se construyó frente al cementerio” no es factible. Así, como que actualmente no es factible desviar las aguas pluviales a otros sectores aledaños. Aunado ello, se invocó que de conformidad con el artículo 20 de la Ley General de Caminos Públicos, la parte recurrente debe soportar las aguas pluviales. Así, respecto a este extremo, conviene recordar a la parte recurrente que el recurso de amparo es de carácter eminentemente sumario —es decir, breve y sencillo— y su tramitación no es compatible con la práctica de diligencias probatorias lentas y complejas, o con la necesidad de entrar previamente a examinar —con carácter declarativo— si los derechos de rango infra constitucional que las partes citan como parte del elenco fáctico del recurso de amparo o del informe de ley, según sea el caso, existen en realidad. Sobre este punto, en la sentencia No. 2019002632 de las 09:30 horas del 15 de febrero de 2019, se resolvió lo siguiente:

“III.- SOBRE EL PRESUNTO DESFOGUE IRREGULAR DE AGUAS EN LA PROPIEDAD DEL RECURRENTE. En primer término, el recurrente acusa que a través de su propiedad discurren irregularmente aguas pluviales y servidas y que, al respecto, las autoridades de la corporación municipal recurrida no han realizado las gestiones necesarias para atender tal problema, pese a las solicitudes planteadas al efecto. Afirma que su finca se ha ido erosionando y derrumbando en algunos sectores, lo cual genera un enorme peligro, sobre todo en los periodos lluviosos, cuando circula una mayor cantidad de agua. Asimismo, explica que él, como propietario, hizo una caja de registro, compró más alcantarillas e instaló zacate a fin de contener el daño, pero no obtuvo resultados positivos. Por consiguiente, solicita a este Tribunal (ante el problema causado por un alcantarillado deficiente), ordenar a los recurridos, entre otros aspectos, eliminar de su propiedad el citado paso de aguas.

Por su parte, las autoridades de la Municipalidad de Grecia informaron bajo juramento a esta Sala que, con el fin de atender el problema reclamado por el tutelado, en el año 2017 se le aclaró que no se podía eliminar el desagüe que pasa por su finca, pues legamente es prohibido y, concomitantemente, se le proporcionaron 30 alcantarillas de 24 pulgadas para que las instalara en la referida propiedad. Asimismo, aseveraron que el recurrente, desde el año 2017, aceptó ante el municipio la existencia y la permanencia del mencionado desfogue de aguas. Igualmente, explicaron que dicho desfogue es un corte de agua que proviene de la vía pública y que se ajusta a lo dispuesto en el ordinal 20 de la Ley General de Caminos Públicos (Ley No. 5060 de 22 de agosto de 1972), el cual, de modo expreso, señala lo siguiente: “Artículo 20.- Todos los poseedores de bienes raíces, por cualquier título, están obligados a recibir y dejar discurrir dentro de sus predios, las aguas de los caminos cuando así lo determine el desnivel del terreno y, cuando sus fundos estén inmediatos a los desagües de un camino, deberán mantener estos desagües limpios, en perfecto estado de servicio y libres de obstáculos.

El Ministerio o las Municipalidades mandarán a ejecutar el trabajo y cobrarán el trabajo más el cincuenta por ciento (50%) de recargo, si esta obligación no se cumpliere. El Ministerio de Obras Públicas y Transportes y las Municipalidades deberán coordinar con el Ministerio de Agricultura las medidas de protección de los caminos en los proyectos de nuevos trazados o en los trabajos de conservación de los existentes, en las regiones donde los mismos puedan provocar o intensificar la erosión ó desviar el desagüe natural de los campos.” También, las autoridades recurridas informaron que realizaron una inspección en el alcantarillado y determinaron lo siguiente “su estado es bueno y la sección hidráulica no se ha reducido ni presenta infiltraciones o asentamientos”.

Ahora bien, revisadas tales argumentaciones, esta Sala estima que no resulta competente para determinar si, en este caso en particular –por las circunstancias propias del terreno–, el problema que sufre el tutelado con el discurrir de las aguas debe soportarlo o bien, le corresponde al municipio recurrido atenderlo y resolverlo de forma definitiva. Nótese que el recurrente afirma que el caudal de agua es sumamente abundante y ha erosionado su propiedad, al punto de crear hundimientos pero, de otra parte, los recurridos (sin refutar la anterior aseveración), sostienen que el primero debe soportar las referidas aguas, conforme lo señalado en el citado numeral 20 de la Ley General de Caminos Públicos. Sin embargo, todo esto, en esencia, hace referencia a un conflicto de legalidad ordinaria, cuyo conocimiento y resolución escapa del ámbito de competencia de este Tribunal. Este tipo de disputas entrañan una discusión probatoria y técnica cuya resolución excede el carácter eminentemente sumario del recurso de amparo.

Dicho de otro modo, en este proceso no resulta material ni razonablemente posible entrar a un complicado y lento sistema probatorio para analizar y determinar a cuál de las dos partes le corresponde atender el problema reclamado. De ahí que, el recurrente, si a bien lo tiene, deberá formular los alegatos en cuestión ante las vías ordinarias de legalidad –administrativa o jurisdiccionales–, creadas al efecto (Véase, en similar sentido, lo dispuesto recientemente por esta Sala en la Sentencia No. 2019-703 de las 09:15 hrs. de 18 de enero de 2019)”.

Así, de conformidad con el precedente citado, no corresponde a este Tribunal Constitucional en este recurso de amparo determinar si técnicamente o de conformidad con la normativa infra constitucional, la parte recurrente debe recibir las aguas pluviales o si la Municipalidad debe atender y resolver de forma definitiva. Lo anterior, por que ello implica entrar a un complicado y lento sistema probatorio para analizar y determinar a cuál de las dos partes le corresponde atender el problema reclamado. De ahí que, el recurrente, si a bien lo tiene, deberá formular los alegatos en cuestión ante las vías ordinarias de legalidad –administrativa o jurisdiccionales–, creadas al efecto. No obstante, pese a lo anterior, en lo que sí se violaron los derechos fundamentales del recurrente, radica en que pese a que el accionante alegó la problemática que vive con las aguas pluviales, no consta que la Municipalidad de Pococí haya resuelto por escrito sobre ese punto.

Nótese que, la Administración accionada realizó una inspección y emitió un criterio en lo tocante a este extremo, sea el oficio No. OCSM-311-2021 del Departamento de Obras Civiles y Servicios Municipales, empero, no consta que lo consignado allí, se le haya puesto en conocimiento de la parte denunciante. En consecuencia, sobre este extremo, el recurso de amparo debe ser estimado únicamente en lo tocante a la falta de respuesta por escrito.

En otro orden de ideas, en lo atinente al tema de las aguas residuales o “aguas negras”, consta que el recurrente denunció que “no tenía conocimiento de ese daño que se está causando a la propiedad. No solo por la cantidad de agua que ingresa y está erosionando el terreno. También porque se trata de aguas contaminadas con toda clase de sustancias”. Sobre este punto, el Área Rectora de Salud de Pococí del Ministerio de Salud indicó que en todo el cantón central de Pococí no hay un sistema de alcantarillado sanitario para tratamiento de aguas residuales, por lo que las viviendas, comercio e industrias, desfogan sus aguas residuales al cordón y caño. En dicho informe se indicó que “se evidencia en campo la problemática ambiental”. Para dicha instancia, lo que correspondía es la construcción de un alcantarillado sanitario mediante la coordinación entre la Municipalidad de Pococí y el ICAA. La Municipalidad de Pococí indicó también que se dirigió la gestión para la construcción del alcantarillado sanitario para Guápiles al ICAA.

No obstante, en el informe del Instituto recurrido cuestionó el rol del Ministerio de Salud en la aprobación de edificaciones, ya que, legalmente están en la obligación de aprobación de los sistemas de tratamientos de aguas residuales y que tampoco se han emitido una serie de órdenes sanitarias para las personas que incurran en desechar las aguas residuales al cordón y el caño.

Sobre este extremo, conviene reiterar que para cumplir, efectivamente, con la protección a un ambiente sano y ecológicamente equilibrado, el Estado entendido en sentido amplio, está en el deber de disponer de las medidas necesarias para que en las comunidades del país se brinde tratamiento oportuno y efectivo a las aguas residuales o “negras”. En ese sentido, este Tribunal Constitucional ha sido del criterio que, tanto al ICAA, como a las Municipalidades y al Ministerio de Salud, les corresponde -dentro de sus respectivos ámbitos de competencia-, velar por la debida recolección, tratamiento y disposición final de tales aguas. Para el sub examine, consta que las tres representaciones tienen conocimiento de la situación y no se desprende que exista una respuesta coordinada a la problemática en cuestión. Se resalta la posición del ICAA en que este niega que tenga injerencia en el extremo a resolver, pese a que la Municipalidad de Pococí les había remitido una gestión requiriendo apoyo para la materialización de un alcantarillado sanitario, sin que conste que tan siquiera hayan atendido la gestión, a fin de que se pudiera brindar una respuesta definitiva al denunciante.

Por otro lado, coincide la Sala con el ICAA que dentro de esta situación estructural también hay responsabilidad del Ministerio de Salud como de la Municipalidad de Pococí, en el tanto, se han mantenido tolerantes a que se viertan aguas residuales en el alcantarillado pluvial. Tampoco consta que hayan tenido alguna iniciativa proactiva -específicamente la Municipalidad en atención a lo que dispone el artículo 169 constitucional- para materializar una solución a la problemática de las aguas residuales. En fin, de conformidad con la jurisprudencia de este Tribunal Constitucional las tres instituciones tienen responsabilidad en brindar una solución a las aguas residuales, sin que fehacientemente conste una propuesta. Nótese que la Municipalidad y el Ministerio de Salud, afirman que la solución es la construcción de alcantarillado sanitario, pero el ICAA sostiene que en caso de no existir sistema de alcantarillado sanitario, la disposición de las aguas residuales debe realizarse mediante sistemas individuales a saber, tanques sépticos más su respectivo drenaje. Así las cosas, lo que procede es declarar con lugar el recurso, con las consecuencias que se dirán en la parte dispositiva de esta sentencia.

Voto salvado parcial respecto a la parte dispositiva de esta sentencia de la Magistrada Garro Vargas. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto respecto a la segunda orden de la parte dispositiva de esta sentencia, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso, para que las autoridades recurridas prevean una solución definitiva a la problemática de aguas residuales denunciados por el recurrente en su propiedad. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

Documentación aportada al expediente. Debe prevenir esta Sala a las partes que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. En consecuencia, se ordena a: 1) a Manuel Hernández Rivera, en su condición de Alcalde de Pococí, o a quien en su lugar ocupe el cargo, gire las órdenes e instrucciones que estén dentro del ámbito de su competencia, para que al recurrente se le comunique por escrito lo resuelto respecto de la denuncia sobre la problemática de aguas pluviales, en el plazo de cinco días, contados a partir de la notificación de esta sentencia; 2) a Manuel Hernández Rivera, en su condición de Alcalde y Juan Luis Gómez Gómez, en su condición de Presidente del Concejo, ambos de la Municipalidad de Pococí; a Karen Mayorga Quirós, en su condición de Directora del Área Rectora de Salud de Pococí y a Eric Alonso Bogantes Cabezas, en su condición de Gerente General y Miguel Antonio Badilla Ugalde, en su condición de Jefe Cantonal de la Oficina de Pococí, ambos del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen esos cargos, para que dentro del plazo de UN MES, contado a partir de la notificación de esta sentencia, en coordinación con las autoridades y entes que correspondan, prevean una solución definitiva a la problemática de aguas residuales denunciados por el recurrente en su propiedad.

Para lo anterior, deberá fijar un cronograma de avance, la delimitación de competencias, las medidas administrativas o técnicas para cumplir con las metas del proyecto, responsables de ejecución y seguimiento y mecanismos de verificación. Posterior al establecimiento de los plazos para el cumplimiento, deberán iniciar con la ejecución del mismo y también, deberán tomar medidas provisionales para mitigar la contaminación con aguas residuales en la propiedad de la parte recurrente. Para esto, deberán notificarle a la parte recurrente, lo acordado, sea, la decisión de la solución definitiva y, el cronograma de avance. Se advierte a la parte recurrida que de, no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena al Estado, a la Municipalidad de Pococí y al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El Magistrado Salazar Alvarado consigna nota. La Magistrada Garro Vargas salva el voto respecto a la ejecución de la segunda orden de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, se lleve a cabo ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.

NOTA DEL MAGISTRADO SALAZAR ALVARADO. En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que denunció que a su propiedad ingresa mucha agua proveniente supuestamente del sistema de alcantarillado que la Municipalidad de Pococí encausó hacia su propiedad, con aguas contaminadas con todo tipo de sustancias, entre ellas, aguas negras y residuales, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
