*CED01* CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and twenty minutes on the twenty-ninth of October two thousand twenty-one.
Writ of amparo (recurso de amparo) filed by [Nombre01 001], holder of national identity document (cédula de identidad) [Valor CED02], against the MINISTERIO DE VIVIENDA Y ASENTAMIENTOS HUMANOS, the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, the INSTITUTO NACIONAL DE VIVIENDA Y URBANISMO, the BANCO HIPOTECARIO DE LA VIVIENDA, AND THE MUNICIPALIDAD DE SAN JOSÉ.
Background:
Likewise, the Service Provision Management stated the following: "The active role that the Municipality of San José has played in seeking to gauge the magnitude of the 'state abandonment' of the Finca San Juan Settlement (Asentamiento) in Rincón Grande de Pavas began in early 2017, when the Department of Human Habitat Improvement and Urban Regeneration was created, and more specifically, the specialized staff-type unit called Housing and Human Settlements Management, responsible for seeking alternative solutions for the eradication of the informal settlements (precarios) of the canton (cantón), as part of an ambitious Housing and Human Habitat Improvement Program in the canton of San José, currently under implementation. Among the annual operational plan (POA) objectives for that year, the development of a concrete work program was established as a priority for this unit, including, among other things, a program for the Finca San Juan Settlement.
Already familiar with the area's problems for 20 years, the staff members began developing an outreach strategy with institutions in the Housing Sector (MIVAH, INVU) and with the Comprehensive Development Association (Asociación de Desarrollo Integral) of Finca San Juan, to address specific but fundamental issues for the community's development. Primarily, an interinstitutional cooperation agenda was proposed with INVU as the registered owner of the Settlement, in order to acquire competence and a leading role in the eradication of El Relleno and El Tapón informal settlements and the activation of the community housing bond (bono comunal) for Finca San Juan, which the Board of Directors (Junta Directiva) of BANHVI approved in 2009 and which, to date, has not been able to be built. With INVU, an Interinstitutional Cooperation Framework Agreement (convenio Marco de Cooperación interinstitucional) was proposed and formalized in May 2019 (attached document 1), which served as the basis for proposing a specific agreement to carry out the pending urban infrastructure works in the western sector of Finca San Juan, using funds from the community housing bond financed by BANHVI (document 2).
The Municipality obtained approval of said agreement in December 2019 (document 3). However, the agreement was never signed because a doubt arose on the Municipality's part as to whether it might ultimately not be recognized by BANHVI, since that institution is, after all, the one that makes the final decision. INVU was asked to obtain a formal and legally valid ruling from BANHVI regarding its acceptance of this public-public alliance between INVU and the Municipality of San José, in June 2021 through official memorandum GPS-GVAH-019-2021 (document 4), but to date, no such ruling has been issued, as acknowledged by the INVU representative in his statement on record in the file. In October 2018, a field survey was conducted together with the Board of the Comprehensive Development Association covering the entire western sector, where the community housing bond works would be carried out. This survey indicates that on boulevard 21 (alameda 21), where the affected person lives, there is an operational potable water network and a wastewater (aguas residuales) collection network duly in operation.
Obviously, as the competent institution indicates, this water is conveyed untreated to the Tiribí River (…). With respect to the information provided by the INVU representative regarding the funding given to the municipality for the construction of the wastewater treatment plant (PTAR) in Finca San Juan, that information is not entirely correct, as the scope of said budget allocation (partida) is to fully design the wastewater treatment plant and, additionally, it will be used in a complementary manner to organize and separate wastewater from stormwater (aguas pluviales), which currently flow mixed into the river, and to build the access infrastructure to the future construction site. The cooperation agreement between MIVAH and the Municipality for this initial phase, for 800 million colones, leaves the environmental sanitation (saneamiento ambiental) situation for San Juan with the need to find 1,400 million colones in financing, according to AyA's own estimates, necessary for the construction of the PTAR.
As a municipality, we maintain an unwavering commitment to executing the community housing bond for Finca San Juan using BANHVI funds, but we consider BANHVI's position regarding the proposed public-public alliance to be unclear and nebulous. After all, with an approved budget of 733 million colones to address problems such as those identified by the petitioner in this amparo writ — funds that have been available for 12 years to carry out said public investment — and given the highly complex operational and construction landscape involved in executing it, it is very difficult to understand BANHVI's reluctance to even issue a negative opinion on the specific and well-structured proposal put forward by the Municipality of San José. It is essential to note that the will of the local government, as represented by the Municipality of San José, has always been at the forefront in confronting and seeking solutions to the problems of the informal zones of the canton, as is its mandate.
In September 2007, the Municipal Council (Concejo Municipal) exceptionally received the streets and public areas of Finca San Juan from INVU (document 5), even though they were not yet completed and had unresolved encroachment issues. Within its limited financial capacity, it has invested significant funds to improve the infrastructure of said settlement. However, within its regular revenues, there are no funding sources that would allow it to take on multi-million-colón projects capable of halting the deterioration of the quality of life of its municipal residents (munícipes). That is why we have implemented an intensive practice of engaging with central government institutions that do have the necessary resources, in the magnitude required to meet environmental sanitation needs such as those in Finca San Juan. Indeed, our strategy of continuing to negotiate capital transfers from national institutions will grow over time; however, that does not prevent us from acknowledging that we are not the primary actors capable of resolving, through our initiative alone, problems such as the present one.
The urban planning law (ley de planificación urbana) only grants us the authority to act as administrators of the territory, overlooking the fact that in many cases, that territory suffers from the atrophy of institutionalized deterioration in its urban and financial environment, accumulated over decades. We are living under a very well-structured 'what ought to be' of laws and regulations that, in the end, leave the citizen defenseless — who, as in this case, is simply asking to be recognized as a taxpayer like any other, to escape from an informality from which he cannot exit alone using the tools provided by our current legal framework." The Management therefore concludes: "regarding this matter, it is clear that the Municipality has taken all actions within the legally possible framework available to the institution, and that the actions to be taken must be carried out by the public institutions involved that are legitimately empowered to do so, who must then coordinate the support that the Municipality can provide." It requests that the writ be dismissed.
The opinion is drafted by Justice (Magistrado) Araya García ; and,
Considering:
I.Subject of the writ. The petitioner claims a violation of her fundamental rights, alleging that the residents of Pavas, specifically of the Finca San Juan Settlement, Dirección03, do not have access to potable water.
II.Proven facts. The following facts are considered to be duly established and relevant to the resolution of this matter, either because they have been corroborated or because the respondent failed to address them as required in the preliminary order (auto inicial):

III.Background of the Finca San Juan Settlement. For an adequate analysis of the present case, it is relevant to note that this Tribunal has previously considered an amparo petition (recurso de amparo) concerning the situation of the Finca San Juan Settlement in Pavas and the drinking water service. Thus, in judgment no. 2010-020764 of 4:11 p.m. on December 14, 2010, this Constitutional Chamber stated the following: "(…) I.- Subject of the petition. The petitioner alleges that the Instituto Costarricense de Acueductos y Alcantarillados refuses to provide her with drinking water service, as well as sanitary sewer service (alcantarillado sanitario), which violates her fundamental rights (…) IV.- On the specific case. In the case under study, the petitioner considers her fundamental rights to have been violated by the refusal of the Instituto Costarricense de Acueductos y Alcantarillados to provide her with drinking water service, as well as sanitary sewer service.
The petitioner resides in a project located in Finca San Juan de Pavas, financed by an INVU Bono Comunal, the works for which have not yet been handed over to AyA as they remain unfinished. This is an area comprising 360 lots, with very few urbanization works, where all families have fraudulent connections (conexiones fraudulentas). In accordance with the studies and reports, AyA is materially unable to provide the services requested by the petitioner (amparada), pursuant to the provisions of the Customer Service Regulations (Reglamento de Prestación de Servicios a los Clientes), since, the works not having been handed over to AyA, the institution cannot provide a service through assets that do not belong to it. This situation has been made known to the petitioner, who has had an irregular water connection. That being the case, the Chamber finds that AyA's refusal is neither arbitrary nor unreasonable, since it is grounded in a legal impossibility for the reasons already set out.
As reported, AyA is aware that the draft tender specifications for the infrastructure improvement works project at Finca San Juan settlement have received pre-feasibility approval and are under review. It is thus estimated that the financing approval would be presented approximately in November 2010, so AyA is already coordinating actions with INVU for liaison with the technical side before the works begin. V.- Thus, for the reasons stated, the appropriate course of action is to dismiss the petition filed, having found that the challenged decision is grounded in technical and legal criteria. Therefore: The petition is dismissed."
IV.On the Drinking Water Request. After analyzing the evidentiary elements provided, this Tribunal finds that the petitioner's fundamental rights have been violated. This is because the report submitted by the representative of the respondent authority—which is deemed given under oath, with the consequences, including criminal penalties, set forth in Article 44 of the Law governing this Jurisdiction—and the evidence provided for the resolution of the matter, have duly established that the property where the petitioner currently resides forms part of an informal settlement known as Finca San Juan, in the district of Pavas, comprising more than 1,000 properties subdivided from the parent tract. Thus, in 2001, the petitioner filed a request for a new drinking water service with the Instituto Costarricense de Acueductos y Alcantarillados, proceeding no. P11112001120101. However, that request was not approved, since the settlement known as Finca San Juan, located in the district of Pavas, has not been approved or received by ICAA with respect to construction plans and the acceptance of infrastructure works constructed.
Likewise, since August 20, 2002, the Instituto Costarricense de Acueductos y Alcantarillados has notified the petitioner of the problem preventing the approval of the requested new service. Furthermore, in 2011, the petitioner filed a request for a new drinking water service with the Instituto Costarricense de Acueductos y Alcantarillados, proceeding no. P11132011020001. However, that request was not approved, since the settlement known as Finca San Juan, located in the district of Pavas, has not been approved or received by ICAA with respect to construction plans and the acceptance of infrastructure works constructed. Subsequently, in July 2020, the petitioner filed a request for a new drinking water service with the Instituto Costarricense de Acueductos y Alcantarillados, request no. 2020-00028626-1. However, that request was not approved, since "the property is located in a project that does not have acceptance of works and also lacks drinking water infrastructure adjacent to the boundary bordering the public road."
This Tribunal finds, however, that this denial (denegatoria) is related to a lack of coordination among the respondent institutions (instituciones recurridas) in resolving the situation of the Asentamiento Finca San Juan. This is because it has been established that, with respect to the irregular settlement (asentamiento irregular) known as Asentamiento Finca San Juan, institutions such as the Instituto Nacional de Vivienda y Urbanismo, the Banco Hipotecario de la Vivienda, and the Municipalidad de San José have taken steps to address the irregular status of said settlement. At present, the Instituto Nacional de Vivienda y Urbanismo has requested, and is still awaiting, the Municipal agreement approving the modification of the project's scope. Furthermore, the Instituto Nacional de Vivienda y Urbanismo submitted a request to BANHVI for consultation and/or approval of the direct contracting of the Municipalidad de San José as contractor and consultant, so that it may design the blueprints, obtain the permits, and carry out the works. That request is still pending a response. However, the Municipalidad de San José does not agree with the agreement signed with INVU, as it considers that BANHVI has not been clear regarding the available budget. Consequently, although these institutions are coordinating to resolve the problem, there are disagreements regarding the project.
In this regard, the violation of the petitioner's (recurrente) fundamental rights is established. This is so because the respondent authorities (autoridades recurridas) have been aware of the problem for more than 10 years, and the irregular status of the said property is therefore long-standing. It should be noted that, from the evidence submitted, it was determined that the Defensoría de los Habitantes intervened and requested inter-institutional coordination more than ten years ago. Therefore, while it is formally established that the project has not been received by ICAA—which technically and legally prevents the approval and provision of the service—it is equally true that the project has been unable to be received due to coordination problems among the institutions and the failure to complete the pending works, which have already been identified. Therefore, this Tribunal finds it appropriate to note that, in settled case law (jurisprudencia), it has been held that the coordination principle (principio de coordinación) operates among the various state institutions, establishing that the State is obligated to ensure that its entities adopt and implement all measures necessary to organize and harmonize their actions, so that administrative management is as swift and effective as possible for the benefit of those subject to its authority (administrado), as well as in accordance with the constitutional principles of efficacy, efficiency, simplicity, and speed in the organization and performance of administrative functions.
Thus, as long as this lack of coordination persists, the problem of potable water supply in a highly populated settlement continues unresolved—and, it bears repeating, this situation has been known for a considerable time; indeed, the cited precedent dates to 2010, and even then it was stated that the project would be ready by November 2010, which did not occur. Consequently, this failure of the respondent authorities to coordinate in resolving the irregular status of the Asentamiento Finca San Juan has resulted in the petitioner and other residents of said settlement not receiving potable water service. Therefore, the appropriate course of action is to uphold (con lugar) the appeal.
The parties are hereby notified that any documents submitted in paper form, as well as objects or evidence contained in any additional electronic, computer-based, magnetic, optical, telematic, or new-technology device, must be retrieved from the court office within a maximum period of 30 business days counted from the notification of this judgment (sentencia). Otherwise, all materials not retrieved within this period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial in session N° 43-12 held on May 3, 2012, Article LXXXI.
Por tanto:
The appeal is hereby upheld. Irene Campos Gómez, in her capacity as Minister of the Ministerio de Vivienda y Asentamientos Humanos; Erick Solano Coto, in his capacity as Executive President of the Instituto Nacional de Vivienda y Urbanismo; Dagoberto Hidalgo Cortés, in his capacity as General Manager of the Banco Hipotecario de la Vivienda; Tomás Francisco Martínez Baldares, in his capacity as Executive President of the Instituto Costarricense de Acueductos y Alcantarillados; and Paula Vargas Ramírez, in her capacity as Mayor of the Municipalidad de San José, or whoever may hold those positions in their stead, are hereby ordered to establish the appropriate coordination mechanisms among all of the following institutions: the Ministerio de Vivienda y Asentamientos Humanos, the Instituto Nacional de Vivienda y Urbanismo, the Banco Hipotecario de la Vivienda, the Instituto Costarricense de Acueductos y Alcantarillados, and the Municipalidad de San José, so that, within their respective areas of competence, all pending work is executed and completed within a maximum period of 24 months, counted from the notification of this judgment, thereby resolving the matter of potable water service provision in the Asentamiento Finca San Juan.
The respondent authorities are hereby warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order—issued within an amparo proceeding (recurso de amparo)—that they are required to comply with or to enforce, and who fails to comply with or enforce it, provided that the offense is not more severely punishable under another provision. The State, the Instituto Nacional de Vivienda y Urbanismo, the Instituto Costarricense de Acueductos y Alcantarillados, and the Municipalidad de San José are ordered to pay the costs (costas), damages, and losses caused by the facts underlying this ruling, which shall be assessed in enforcement of judgment (ejecución de sentencia) before the contencioso administrativo court. Recurso de amparo interpuesto por [Nombre01 001], cédula de identidad [Valor CED02], contra el MINISTERIO DE VIVIENDA Y ASENTAMIENTOS HUMANOS, el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, el INSTITUTO NACIONAL DE VIVIENDA Y URBANISMO, el BANCO HIPOTECARIO DE LA VIVIENDA Y LA MUNICIPALIDAD DE SAN JOSÉ.
Resultando:
Redacta el Magistrado Araya García ; y,
Considerando:
I.Objeto del recurso. La recurrente reclama violación a sus derechos fundamentales, pues acusa que los vecinos de Pavas, específicamente del Asentamiento Finca San Juan, Dirección03, no cuentan con agua potable.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

- Sobre la solicitud de agua potable de la recurrente:
III.Antecedentes del Asentamiento Finca San Juan. Para el análisis adecuado del presente caso, es relevante indicar que este Tribunal conoció un recurso de amparo sobre la situación del Asentamiento Finca San Juan en Pavas y el servicio de agua potable. Así, en la sentencia no. 2010-020764 de las 16:11 horas del 14 de diciembre de 2010, esta Cámara Constitucional señaló lo siguiente: “(…) I.- Objeto del recurso. La recurrente alega que el Instituto Costarricense de Acueductos y Alcantarillados se niega a suministrarle el servicio de agua potable, así como el alcantarillado sanitario, lo que lesiona sus derechos fundamentales (…) IV.- Sobre el caso concreto. En el caso bajo estudio, la recurrente considera lesionados sus derechos fundamentales por la negativa del Instituto Costarricense de Acueductos y Alcantarillados en brindarle servicio de agua potable, así como el servicio de alcantarillado sanitario.
La recurrente habita en un proyecto ubicado en Finca San Juan de Pavas, financiado con bono comunal del INVU, cuyas obras aún no han sido entregadas al AyA pues se encuentran sin concluir. Se trata de una zona que cuenta con 360 lotes, con muy pocas obras de urbanización, donde todas las familias tienen conexiones fraudulentas. De conformidad con los estudios e informes, el AyA se encuentra en imposibilidad material de brindar los servicios solicitados por la amparada, de acuerdo con lo estipulado en el Reglamento de Prestación de Servicios a los Clientes, toda vez que al no haber sido entregadas las obras todavía al AyA, la institución no puede prestar un servicio por medio de activos que no le pertenecen. Lo anterior ha sido puesto en conocimiento de la amparada, quien ha contado con una conexión de agua irregular. Así las cosas, aprecia la Sala que la negativa del AyA no resulta arbitraria ni irrazonable, toda vez que se fundamenta en una imposibilidad jurídica por las razones ya expuestas.
Según se informó, el AyA conoce que el borrador del cartel del proyecto de obras de mejoramiento del asentamiento Finca San Juan se encuentra con pre factibilidad aprobada y en etapa de revisión. De manera que se estima que aproximadamente en noviembre del 2010 se estaría presentando la aprobación del financiamiento, por lo que el AyA coordina desde ya acciones con el INVU para el enlace con la parte técnica antes que inicien las obras. V.- Así, en razón de lo expuesto, lo procedente es desestimar el recurso planteado por constatar que la decisión cuestionada tiene fundamento en criterios técnicos y jurídicos. Por tanto: Se declara sin lugar el recurso”.
IV.Sobre la solicitud de agua potable. Después de analizar los elementos probatorios aportados, este Tribunal verifica que ha existido violación a los derechos fundamentales de la recurrente. Lo anterior, porque en el informe rendido por el representante de la autoridad recurrida -que se tiene por dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, ha sido debidamente acreditado que el inmueble en donde habita actualmente la recurrente forma parte de un asentamiento irregular conocido como Finca San Juan, en el distrito de Pavas, que se conforma de más de 1.000 propiedades segregadas de la finca madre. Así, en el 2001, la recurrente presentó la solicitud de nuevo servicio de agua potable ante el Instituto de Acueductos y Alcantarillados, gestión no. P11112001120101.
No obstante, dicha solicitud no fue aprobada, ya que dicho asentamiento conocido como Finca San Juan, ubicado en el distrito de Pavas, no ha sido aprobado, ni recibido por el ICAA, en lo referente a planos constructivos y al recibo de obras de infraestructura construidas. Igualmente, desde el 20 de agosto del 2002, el Instituto de Acueductos y Alcantarillados le comunicó a la recurrente la problemática que impedía aprobar el nuevo servicio solicitado. Además, en el 2011, la recurrente presentó la solicitud de nuevo servicio de agua potable ante el Instituto de Acueductos y Alcantarillados, gestión no. P11132011020001. No obstante, dicha solicitud no fue aprobada, ya que dicho asentamiento conocido como Finca San Juan, ubicado en el distrito de Pavas, no ha sido aprobado, ni recibido por el ICAA, en lo referente a planos constructivos y al recibo de obras de infraestructura construidas. Posteriormente, en julio de 2020, la recurrente presentó la solicitud de nuevo servicio de agua potable ante el Instituto de Acueductos y Alcantarillados, solicitud no. 2020-00028626-1.
No obstante, dicha solicitud no fue aprobada, pues “el inmueble está localizado en un proyecto que no cuenta con recepción de obras y tampoco cuenta con infraestructura de agua potable frente al lindero colindante con calle pública”.
Ahora bien, este Tribunal constata que esta denegatoria está relacionada con una falta de coordinación entre las instituciones recurridas para solventar la situación del Asentamiento Finca San Juan. Esto, pues se comprueba que, respecto al Asentamiento irregular Finca San Juan, instituciones como el Instituto Nacional de Vivienda y Urbanismo, el Banco Hipotecario de la Vivienda y la Municipalidad de San José han realizado acciones para solucionar la situación de irregularidad de dicho Asentamiento. Así, actualmente, el Instituto Nacional de Vivienda y Urbanismo solicitó y está pendiente el acuerdo Municipal sobre la aprobación de la modificación del alcance del proyecto. Además, el Instituto Nacional de Vivienda y Urbanismo solicitó ante el BANHVI sobre la consulta y/o aprobación para la contratación directa de la Municipalidad de San José como constructora y consultora, para que diseñe los planos, gestiones los permisos y ejecute las obras. Dicha gestión está pendiente en ser atendida. Sin embargo, la Municipalidad de San José no está de acuerdo con el convenio firmado con el INVU, pues considera que el BANHVI no ha sido claro respecto al presupuesto existente. Por consiguiente, aunque dichas instituciones están coordinando para solucionar el problema, existen discrepancias sobre el proyecto.
En este sentido, se constata la violación a los derechos fundamentales de la recurrente. Lo anterior, pues las autoridades recurridas conocen la problemática desde hace más de 10 años, por lo que la situación de irregularidad de la dicha finca es de vieja data. Nótese que, de la prueba aportada, se determinó que la Defensoría de los Habitantes intervino y solicitó coordinación entre instituciones desde hace más de diez años. Por ende, si bien es cierto que formalmente se determina que el proyecto no ha sido recibido por el ICAA, y que eso impide técnica y legalmente la aprobación y prestación del servicio, también es cierto que el proyecto no ha podido ser recibido por los problemas de coordinación entre las instituciones y la falta de construcción de las obras pendientes, las cuales ya fueron identificadas. Por ende, este Tribunal considera prudente señalar que, en reitera jurisprudencia, se ha indicado que existe el principio de coordinación que opera entre las diferentes instituciones estatales, que establece que el Estado está obligado a que sus entidades adopten e implementen todas aquellas medidas requeridas para organizar y armonizar sus actuaciones, para que la gestión administrativa sea lo más célere y efectiva posible en beneficio del administrado, así como los principios constitucionales de eficacia, eficiencia, simplicidad y celeridad de la organización y función administrativas.
Así, mientras se mantiene esa falta de coordinación, se perpetúa el problema de suministro de agua potable en un asentamiento altamente poblado, y, se reitera, de lo que se tiene conocimiento desde hace bastante tiempo, incluso el precedente señalado es del 2010 y ya en ese precedente se indicó que el proyecto estaría listo en noviembre de 2010, lo cual no sucedió. Por consiguiente, dicha falta de coordinación de las autoridades recurridas para solventar la situación de irregularidad del Asentamiento Finca San Juan ha derivado en que la recurrente y demás residentes de dicho asentamiento no reciban el servicio de agua potable. Por lo tanto, lo procedente es declarar con lugar el recurso.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Irene Campos Gómez, en su condición de ministra de Vivienda y Asentamientos Humanos, a Erick Solano Coto, en su condición de presidente ejecutivo del Instituto Nacional de Vivienda y Urbanismo, a Dagoberto Hidalgo Cortés, en su condición de gerente general del Banco Hipotecario de la Vivienda, a Tomás Francisco Martínez Baldares, en su condición de presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, y a Paula Vargas Ramírez, en su condición de alcaldesa de la Municipalidad de San José, o a quienes en sus lugares ocupen esos cargos, establecer las instancias de coordinación que corresponda entre todas las siguientes instituciones Ministerio de Vivienda y Asentamientos Humanos, Instituto Nacional de Vivienda y Urbanismo, Banco Hipotecario de la Vivienda, Instituto Costarricense de Acueductos y Alcantarillados, y la Municipalidad de San José, para que, en el ámbito de sus competencias, se ejecute y construya lo pendiente de realizar, lo anterior en el plazo máximo de 24 meses, contados a partir de la notificación de la presente sentencia , y así, se resuelva lo que corresponda respecto de la prestación del servicio de agua potable en el Asentamiento Finca San Juan.
Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado, al Instituto Nacional de Vivienda y Urbanismo, al Instituto Costarricense de Acueductos y Alcantarillados y a la Municipalidad de San José al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese.
