Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine fifteen in the morning on the twenty-second of October, two thousand twenty-one.
Writ of amparo (recurso de amparo) filed under case file No. 21-018760-0007-CO by Nombre01, national identity document (cédula de identidad) CED01, against the MUNICIPALIDAD DE OSA AND THE COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS.
Background:
"…Furthermore, that sector is also included in a long-term, permanent proposal; accordingly, since February 23, 2018, through official memorandum SGR-OFI-INSP-0014-2018, neighboring residents were notified that the General Emergency Plan (Plan General de emergencia) stemming from the situations caused by Tropical Storm Nate on the Río Balzar has been under development since 2017. Additionally, on November 12, 2019, the petitioner was informed through official memorandum CMEOSA-OFI-0102-2019 that, as a result of the damage caused by Tropical Storm Nate — which had been declared a state of emergency pursuant to Emergency Decree N° 40677-MP — it was possible to include within the General Emergency Plan the situation occurring on the Río Balzar in the area of Dirección02 Laguna. This made it possible to coordinate among the Fluvial Works Division (Obras Fluviales) of MOPT, SENARA, and this Municipality to develop jointly with CNE an Investment Plan (Plan de Inversión), in which SENARA acts as the Implementing Unit (Unidad Ejecutora) for the required protective works.
As of this date, the present process has advanced to the point where the designs have been completed and the works are in the award phase, as indicated in expediente 2021CE-000036-0006500001 'Construcción de obras de protección en el río Grande de Térraba, sectores de Palmar Sur y Ciudad Cortés, cantón de Osa, Puntarenas,' which is publicly accessible through the SICOP Platform and which includes channel dredging works on the Río Balzar. Therefore, all emergencies activated through the 9-1-1 protocol — which enables the management of the aforementioned undeclared emergency responses — have been attended to in a timely manner; the problem of the river's encroachment along the right bank downstream has been resolved through mitigation measures, an encroachment caused by hydraulic force (fuerza hidráulica) due to the river's location on a curve with flat topography and non-rocky soils, through assessments and joint efforts between the Road Management Technical Unit and the Risk Management Department (Departamento de Gestión del Riesgo) to handle the 'first impacts.' Furthermore, responses and solutions have been provided within the scope available to the Municipality of Osa, and the entire community of Barrio La Laguna and the broader community of Ciudad Cortés have been kept informed about the works to be executed…" "…The coordinator of the Municipal Emergency Committee reports that in the month of November, the canton of Osa experienced severe impacts due to the effects of Hurricane ETA, as recorded in situation report N° CMEOSA-INF-N°0072-2020.
This situation led to a precise assessment of the impacts experienced in the vicinity of the property referenced by the petitioner. As part of that effort and in accordance with the request set forth in the First Impact or Undeclared Emergency Request document dated November 16, 2020, 300 hours of heavy machinery (D8 Tractor) were obtained, through which rechanneling (re encauzamiento) works were carried out on the Río Balzar. Likewise, on September 14, 2021, further impacts occurred in Barrio La Laguna; in response thereto and as recorded in situation report N° CMEOSA-INF-N°0037-2021, the corresponding assessments were conducted and a request for 150 hours of D8 tractor was submitted to CNE to expand the channeling (canalización) and rechanneling works; this request is currently under administrative review by CNE. The foregoing demonstrates that, through the appropriate legal and administrative mechanism, the Municipality of Osa and the Municipal Emergency Committee of Osa have properly addressed — from both a technical and legal standpoint — the situation presented at Dirección01, through the management of undeclared emergencies or first-impact requests (solicitudes de primer impacto), which are provided for under Article 30, paragraph a) of ley 8848 and Article 2, paragraph c), and Article 14, of its regulations.
As stated above, a long-term solution also exists; accordingly, CNE currently has in its award process the project 'Construcción de obras de protección para los sectores de Palmar Sur, Palmar Norte y Ciudad Cortés, río Grande de Térraba, Osa, Puntarenas' (Levee [Dique]), which encompasses the complete dredging of the Río Balzar and the extension of the existing levee over this channel. This project would exponentially improve the situation experienced by the petitioners in the constitutional protection writ (amparo) case at hand; this Municipality has been actively involved in the operational aspects of this process, conducting community outreach for the project and obtaining voluntary right-of-way permits (permisos de paso), issued by the owners of private parcels crossed by the levee alignment — an element that eliminates any expropriation proceedings or judicial dispute — as evidenced in attendance lists in which the petitioner herself has participated.
It is important to note that, regarding the project cited in the preceding paragraph, Compañía Palma Tica S.A. filed on September 10 a REJECTION OF REQUEST AND CONCOMITANT INCIDENT OF ABSOLUTE NULLITY; this situation caused the case to be transferred to the legal department of CNE, which must analyze the terms of execution of said project — a situation that appears to fall outside the scope of action of this Municipality and the Municipal Emergency Committee of Osa." They request that the appeal be dismissed.

Considering:
Before analyzing the merits of the matter — on the alleged violation of the right to prompt and effective proceedings — it must be clarified that, since judgment No. 2008-02545 of 8:55 a.m. on February 22, 2008, this Chamber has referred — with some exceptions — to the administrative litigation jurisdiction (jurisdicción contencioso administrativa) those matters in which the question is whether the public administration has or has not complied with the deadlines established by the General Law of Public Administration (articles 261 and 325) or by sectoral laws for special administrative procedures, in order to resolve through a final administrative act (acto final) an administrative procedure — initiated ex officio or at the request of a party — or to hear applicable administrative appeals. Precisely, in this case, an exceptional situation is presented, as this involves a complaint filed before the Osa Municipality concerning an environmental situation and a threat to the physical integrity of the protected party (amparada) and other residents. Having clarified that point, the Court proceeds to resolve the specific situation raised in this constitutional protection writ (amparo).
The appellant states that since 2013, a property she owns located at Dirección01, Ciudad Cortés, in Osa, has been affected because the Balzar River has undermined a large portion of the land, a situation that worsens during the rainy season. She notes that the dwelling in which she resides with her family is located at a distance of only 50 meters from the riverbed, putting her physical integrity, life, and property at risk. She adds that on several occasions she approached the Osa Municipality and CNE to seek a solution to the problem. She alleges that among the requests she filed are those dated February 7, 2018, October 28, 2019, and November 13, 2020, in which she reported the situation. She claims that, as of the date this writ was filed, her complaints have not been resolved.
Of relevance to the decision in this matter, the following facts are considered duly established, either because they have been proven on the record or because the respondent failed to address them as required by the initial order:
In view of this urgency, I ask that the affected families be informed of the contingency plan (plan de contingencia) to be implemented and the specific actions that comprise it, as well as the schedule for carrying out the works and the parties responsible for executing them…" (see attached evidence).
The following facts of relevance to this ruling are not considered to have been established:
This Chamber, in judgment No. 2006-9198 issued at 14:56 hours on July 4, 2006, considered an amparo petition (recurso de amparo) filed by the protected party against the authorities named as respondents here. On that occasion, the petitioner sought a solution to the problems suffered at her home as a result of landslides originating from a stream (quebrada) running alongside her residence. This Tribunal granted the petition and ordered the respondent authorities to take the necessary measures to reconstruct the eroded embankment (talud) adjacent to the residence of Nombre02, and to comply with the reports of the National Commission for Risk Prevention and Emergency Response Nº DMP-INF-711-2003 and CUE-421-GS-2006.
The petitioner alleges that since 2013, a property she owns located at Dirección01, Ciudad Cortés in Osa, has been affected because the río Balzar has undermined a large portion of the land, a situation that worsens during the rainy season. She notes that the dwelling in which she lives with her family is located only 50 meters from the riverbed, placing her physical integrity, her life, and her property at risk. She alleges that the submissions she has made to the Municipalidad de Osa include those dated February 7, 2018, October 28, 2019, and November 13, 2020—letters through which she has reported this situation but has received no response, and the problem continues.
In this regard, the municipal entity reports that it is aware of the appellant's situation. Likewise, from the report submitted by the representatives of the respondent local government—which is taken as given under oath, with the consequences, including criminal ones, provided for in Article 44 of the Law governing this Jurisdiction—and from the body of evidence (elenco probatorio), it is established that by means of a written submission dated January 15, 2018, addressed to the coordinator of the Comisión Nacional de Emergencias of the Cantón de Osa and to the Consejo Municipal de Osa, Alberto Cole de León (mayor), with a received date of February 07, 2018, the protected party (amparada) and other persons requested the following: "… We request intervention with regard to the RIO BALZAR. Which is the one that encompasses everything around Ciudad Cortés. Therefore, once again we hope for your full support and for the relevant works to be carried out, for on our end the river has already consumed a great deal of land, GETTING CLOSER AND CLOSER to us and to the Main Road.
WITH THE IMPACT OF STORM NETH on October 05 and 06, 2017. Which was one of the largest floods. We believe that both the National and Local Governments should be united and provide the necessary assistance…". Likewise, on February 23, 2018, by means of official communication SGR-OFI-INSP-0014-2018, the respondent municipal corporation (corporación municipal) informed the residents that a General Emergency Plan had been under development since 2017, in response to the situations caused by Storm Nate on the Río Balzar. It is further verified that through the written submission dated October 28, 2019, addressed to the Consejo Municipal de Osa and to the coordinator of the Comisión Nacional de Emergencias of the Cantón de Osa (Alberto Cole de León, mayor), with a received date of October 28, 2019, the protected party filed the following complaint: "…Dear Sir, with regard to the imminent danger faced by a group of approximately 10 families including my own.
The families are made up of elderly persons, young people, adults, and minors. At this moment we find ourselves in a state of defenselessness due to the advancing flow of the Río Balzar, which 2 years ago swept away a large portion of my property and that of my neighbors, leaving us completely exposed and in danger from any rise in its flow; we ask that you use your good offices to bring about the implementation of specific actions. On repeated occasions we have raised the alarm about the rising flow of the river, and officials from various government agencies such as the public security forces, the emergency commission, and others have come to the site, limiting themselves to taking photographs and commenting on what they believe should be done, without those comments having translated, to date, into any effective works that securely protect our lives and material assets: with the exception of dredging the riverbed on several occasions; an action that, on its own, clearly does not offer a real solution to the danger in which we find ourselves.
In view of this urgency, I ask that the affected families be informed of the contingency plan to be implemented and the specific actions that comprise it, as well as the schedule for carrying out the works and who is responsible for executing them…". By means of official communication CMEOSA-OFI-0102-2019 of November 12, 2019, Alexander Zúñiga Medina, in his capacity as coordinator of the Disaster Risk Management Unit (Unidad Gestión del Riesgo de Desastres) of the Municipalidad de Osa, prepared a response to the protected party regarding her submission of October 28, 2019. In addition, by means of the written submission dated November 13, 2020, addressed to the Consejo Municipal de Osa and to the coordinator of the Comisión Nacional de Emergencias of the Cantón de Osa, with a received date of November 13, 2020, the protected party stated the following, which is transcribed below: "…Dear Sir, with regard to the imminent danger posed by various past natural phenomena.
Faced by the Barrio La Laguna, located in the district of Ciudad Cortés, due to the defenselessness against the advancing flow of the Río Balzar during the rainy season (época de invierno), this year 2020 was no exception, with Hurricane ETA sweeping through my property and those of neighboring residents on a large scale, leaving us in evident danger. On repeated occasions we have raised the alarm about the rising flow of the Río Balzar to the Comisión Nacional de Emergencias. We respectfully ask that you use your good offices to bring about the implementation of specific actions in the form of effective works that securely protect our lives…". It is noted that on November 16, 2020, pursuant to a document entitled "Solicitud de Primer Impacto o Emergencia No Declarada" (Request for First Impact or Undeclared Emergency), 300 hours of heavy machinery (Caterpillar D8 tractor) were obtained, through which rechanneling (reencauzamiento) works were carried out on the Río Balzar.
It is further confirmed that due to the damage caused by Tropical Storm Nate, which had been declared an emergency pursuant to emergency decree N° 40677-MP, it was possible to include the situation occurring on the Río Balzar in the Dirección01 sector within the General Emergency Plan. To that end, a Joint Investment Plan was developed with MOPT, SENARA, and the respondent Municipalidad, together with CNE, in which SENARA serves as the Executing Unit (Unidad Ejecutora) for the required protection works. The designs were completed and the works were in the award (adjudicación) phase pursuant to procurement file 2021CE-000036-0006500001, "Construcción de obras de protección en el río Grande de Térraba, sectores de Palmar Sur y Ciudad Cortés, cantón de Osa, Puntarenas." These works include, among others, the design and construction of protection works in the Dirección01 sector of Ciudad Cortés (works expected to be executed during the next dry season in the area).
Furthermore, the Barrio La Laguna sector has been receiving interventions through undeclared emergency contracting (first impact) requested by the Municipalidad de Osa. The contract was processed in November 2020 and became effective in January 2021, consisting of 300 effective hours of a Caterpillar-type D8 model tractor, pursuant to procurement process 2021PI-000024-0006500001. This type of works constitutes corrective actions intended to momentarily mitigate the problem, given their nature as works contracted on an expedited basis, without fluvial mechanics studies (estudios de mecánica fluvial). These actions are rapid-response works designed to alleviate situations arising from localized events. Likewise, on September 14, 2021, further damage occurred in Barrio La Laguna; in response, and as documented in situation report N° CMEOSA-INF N° 0037-2021, the corresponding assessments were carried out and a request was submitted to the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias for 150 hours of a D8 tractor to expand channeling and rechanneling works; this request was pending administrative processing at CNE.
While it can be demonstrated that the Municipalidad de Osa has made efforts to alleviate the situation described by the appellant in her filing, as of the date this writ of amparo (recurso de amparo) was filed there is no record that the respondent municipal council (ayuntamiento) had provided a definitive solution to the problem set forth. Nor is there evidence that official communication CMEOSA-OFI-0102-2019 of November 12, 2019, prepared in response to the protected party's submission of October 28, 2019, was ever communicated to the appellant. Likewise, there is no record that a response was provided to the petitioner (petente) regarding the submissions filed on February 07, 2018 and November 13, 2020.
For the foregoing reasons, the appropriate course of action is to uphold the writ, on the terms set out in the operative part (parte dispositiva).
The appellant states that she turned to both the Municipalidad de Osa and the Comisión Nacional de Emergencias seeking a solution to the flooding problem affecting her property and that of her neighbors, resulting from the overflow of the Río Balzar.
In this regard, there is no evidence that any submission was filed directly with the Comisión Nacional de Emergencias; for this reason, the failure to address the requests dated February 07, 2018, October 28, 2019, and November 13, 2020 cannot be attributed to it. In any event, it should be noted that the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, on August 17, 2018, August 22, 2019, and November 16, 2020, took the necessary actions at the request of the Municipalidad de Osa to mitigate the impact caused by the extraordinary flow generated by the Río Balzar in several communities, including Dirección04.
Accordingly, with respect to this aspect, the writ is denied.
In environmental matters, it is the view of the undersigned that where there has already been intervention by the Public Administration, jurisdiction to hear and resolve the matter belongs to the administrative contentious jurisdiction (jurisdicción contenciosa administrativa). Nonetheless, I do proceed to examine the merits of the matter when other rights of persons affected by flood-related contamination are at stake, including health, quality of life, and the right to enjoy a healthy environment free from contamination (Article 50 of the Constitución Política), as is the case here, in which the respondent authorities are accused of failing to take measures such as cleaning a stream (quebrada), given that it causes flooding in the protected party's home, among other matters. In this regard, such omission affects the physical and mental health of the appellant, in violation of the right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.
IX.PARTIAL DISSENTING VOTE (VOTO SALVADO PARCIAL) WITH RESPECT TO THE OPERATIVE PART OF THIS JUDGMENT BY JUSTICE GARRO VARGAS. While I concur with the majority of the Chamber that the writ should be partially upheld, I disagree as to where the enforcement phase of the first order given in the operative part should be lodged, due to the absence of adequate mechanisms provided by the rules governing this constitutional jurisdiction to monitor a judgment that involves technical aspects of great complexity, as is the case here with "the requirement that a definitive solution be provided, as appropriate, to the problem that is the subject of this writ, all within a period of TWELVE MONTHS counted from the notification of this judgment." By contrast, what is provided by the Código Procesal Contencioso-Administrativo regarding enforcement (Article 155 and following) has evident advantages, such as the possibility of requesting timetables, imposing fines, establishing responsibilities, and monitoring stages of compliance, among others. Therefore, in accordance with the provisions of Article 56 of the Ley de Jurisdicción Constitucional, I consider that the enforcement phase must be carried out before the Enforcement Division (Área de Ejecución) of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment enforcement rules of that Code.
This Chamber must advise the petitioner that if any documents have been submitted — whether in paper form, as physical objects, or as evidence stored on any additional device, or in electronic, computer-readable, magnetic, optical, telematic, or other new-technology format — such materials must be retrieved from the office within 30 working days (días hábiles) of receipt of notification of this judgment; otherwise, all such materials will be destroyed in accordance with the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial" [Regulations on the Electronic Case File before the Judiciary], approved by the Full Court (Corte Plena) in session N° 27-11 of August 22, 2011, article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Superior Council of the Judiciary (Consejo Superior del Poder Judicial) in session N° 43-12 held on May 3, 2012, article LXXXI.
Por tanto:
The writ of amparo (recurso de amparo) is partially granted, solely against the Municipalidad de Osa. Jorge Alberto Cole de León, Alfredo Soto Elizondo, Rodney Gamboa Carvajal, and Jesús Mora Villalobos — serving, respectively, as mayor (alcalde), president of the Municipal Council (Concejo Municipal), director of the Technical Road Management Unit (Unidad Técnica de Gestión Vial), and coordinator of the Municipal Emergency Committee (Comité Municipal de Emergencias), or whoever may hold those positions in their stead — are ordered to issue the necessary directives and carry out the necessary coordination within the scope of their respective competencies, including coordination with CNE, so that a definitive solution, as appropriate, is provided to the problem that is the subject of this writ, all within a period of TWELVE MONTHS counted from the notification of this judgment. Likewise, the protected party (amparada) is to be notified of official communication CMEOSA-OFI-0102-2019 of November 12, 2019, which was drafted in response to the petition submitted on October 28, 2019.
In addition, responses are to be provided to the petitions submitted by the protected party on February 7, 2018, and November 13, 2020, all within a period of FIVE DAYS from the notification of this judgment. The respondent is hereby warned that, pursuant to article 71 of the Constitutional Jurisdiction Act (Ley de la Jurisdicción Constitucional), imprisonment of three months to two years, or day-fines (días multa) of twenty to sixty days, shall be imposed on any person who receives an order — which that person is required to comply with or enforce — issued in a writ of amparo and fails to comply with or enforce it, provided the offense is not more severely punishable under another provision. In all other respects, the writ is denied. The Municipalidad de Osa is ordered to pay costs, damages, and losses (costas, daños y perjuicios) arising from the facts underlying this ruling, to be assessed in enforcement proceedings before the contentious-administrative jurisdiction (lo contencioso administrativo).
In all other respects, the writ is denied. Justice (Magistrado) Salazar Alvarado appends a separate concurring note. Justice (Magistrada) Garro Vargas files a dissenting opinion (salva el voto) with respect to enforcement of the first order of this judgment and, pursuant to article 56 of the Constitutional Jurisdiction Act, provides that enforcement must take place before the Enforcement Division (Área de Ejecución) of the Administrative and Civil Tax Court (Tribunal Contencioso Administrativo y Civil de Hacienda), under the enforcement rules set forth in articles 155 et seq. of the Code of Administrative Litigation Procedure (Código Procesal Contencioso Administrativo). She likewise orders that a copy of the judgment be sent to that court so that enforcement proceedings may be initiated. Let notice be served.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veintidos de octubre de dos mil veintiuno .
Recurso de amparo que se tramita en expediente No. 21-018760-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE OSA Y LA COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS.
Resultando:
Redacta la Magistrada Esquivel Rodríguez; y,
Considerando:
De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción pues, se está ante una denuncia interpuesta ante la Municipalidad de Osa por una situación ambiental y de peligro a la integridad física de la amparada y otros vecinos. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
Expone la recurrente que desde el 2013, un inmueble de su propiedad ubicado en Dirección01, Ciudad Cortés en Osa, se ha visto afectado, debido a que el río Balzar ha socavado gran parte del terreno, situación que se agrava durante la época de invierno. Señala que la casa de habitación en la que reside con su familia se encuentra a una distancia de tan solo 50 metros del cauce del río, lo que pone en riesgo su integridad física, su vida y propiedad. Añade que en varias ocasiones acudió a la Municipalidad de Osa y la Comisión Nacional de Emergencias para que se le brinde una solución al problema. Alega que entre las gestiones formuladas se encuentran las de fechas 07 de febrero de 2018, 28 de octubre de 2019 y 13 de noviembre de 2020, misivas en las cuales se ha denunciado dicha situación. Reclama que a la fecha de interposición de este recurso, sus denuncias no han sido resueltas.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la recurrida haya omitido referirse a ellos según lo prevenido en el auto inicial:
Ante esta urgencia le solicito que se nos exponga a las familias afectadas cual es el plan de contingencia a realizar y las acciones concretas que lo componen, así mismo el calendario de ejecución de las obras y quienes son los responsables de ejecutarlas…” (ver prueba adjunta).
No se estiman demostrados los siguientes hechos de relevancia para esta resolución:
Esta Sala en sentencia No. 2006-9198 de las 14:56 horas del 4 de julio de 2006, conoció un recurso de amparo interpuesto por la tutelada en contra de las autoridades aquí recurridas. En aquella oportunidad, la pretensión de la recurrente era que se les brindara una solución a los problemas sufridos en su vivienda producto de los deslizamientos originados por una quebrada que pasa al lado de su hogar. Este Tribunal estimó el recurso y ordenó a las autoridades accionadas, que tomaran las medidas necesarias para que se reconstruyera el talud erosionado adyacente a la vivienda de Nombre02 y que se cumpliera con los informes de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias Nº DMP-INF-711-2003 y CUE-421-GS-2006.
La recurrente alega que desde el 2013, un inmueble de su propiedad ubicado en Dirección01, Ciudad Cortés en Osa, se ha visto afectado, debido a que el río Balzar ha socavado gran parte del terreno, situación que se agrava durante la época de invierno. Señala que la casa de habitación en la que reside con su familia se encuentra a una distancia de tan solo 50 metros del cauce del río, lo que pone en riesgo su integridad física, su vida y propiedad. Alega que entre las gestiones formuladas ante la Municipalidad de Osa se encuentran las de fechas 07 de febrero de 2018, 28 de octubre de 2019 y 13 de noviembre de 2020, misivas mediante las cuales ha denunciado dicha situación, pero no ha recibido respuesta, y la problemática continúa.
Al respecto, la entidad municipal informa que conocen de la problemática de la recurrente. Asimismo, del informe rendido por los representantes del gobierno local recurrido -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y del elenco probatorio, se tiene por acreditado que mediante escrito con fecha 15 de enero de 2018, dirigido al coordinador de la Comisión Nacional de Emergencias del Cantón de Osa y al Consejo Municipal de Osa, Alberto Cole de León (alcalde), con fecha de recibido 07 de febrero de 2018, la amparada y otras personas solicitaron lo siguiente: “… Nosotros solicitamos la intervención en lo respecta al RIO BALZAR. Que es quine cobija todo alrededor de Ciudad Cortés. Por lo tanto una vez más esperamos de ustedes todo ese apoyo y ejecutar los trabajos que correspondan, ya en la parte de nosotros el río a ha logrado consumir mucho terreno, ESTANDO CADA VES MÁS CERCA de nosotros y la de la carretera Principal.
CON LA AFECTACIÓN DE TORMTA NETH del 05 y 06 de Octubre 2017. Que fue una de las inundaciones más grandes. Pensamos que los Gobiernos tanto Nacional como Local estemos unidos y den la ayuda necesaria…”. Asimismo, el 23 de febrero de 2018, mediante oficio SGR-OFI-INSP-0014-2018, la corporación municipal recurrida comunicó a los vecinos que se encuentra en gestión desde el 2017 el Plan General de Emergencia, a raíz de las situaciones que provocó la tormenta Nate en el Río Balzar. Se verifica que a través del escrito con fecha 28 de octubre de 2019, dirigido al Consejo Municipal de Osa y al coordinador de la Comisión Nacional de Emergencias del Cantón de Osa (Alberto Cole de León, alcalde), con fecha de recibido 28 de octubre de 2019, la amparada denunció lo siguiente: “…Estimado señor, en relación al peligro inminente en a que se encuentra u grupo aproximado de 10 famitas incluyendo lo mía. los cuates están integradas por adultos mayores, jóvenes, adultos y menores de edad. que en este momento nos encontramos en un estado de indefensión con el creciente avance del caudal del río Balzar, el cual hace 2 años arrasó con gran parte de mi propiedad y lo de mis vecinos, dejándonos totalmente expuestos y en peligro por cualquier crecida de su caudal, solicitamos interponga sus buenos oficios a fin de concretar la realización de acciones puntuales.
En reiteradas ocasiones hemos dado la voz de alerta por la crecida del caudal del río y los funcionarios de diversas dependencias gubernamentales como la fuerza pública, comisión de emergencias y otros, se presentan al lugar limitándose a tomar fotos, comentar la que a su juicio hay que hacer, sin que esos comentarios se traduzcan a la fecha en alguna obra efectiva que proteja nuestras vidas y bienes materiales de forma segura: con excepción de dragar el cauce del río en varias ocasiones; acción que por sí sola, evidentemente no ofrece una solución real al peligro en el cual nos encontramos. Ante esta urgencia le solicito que se nos exponga a las familias afectadas cual es el plan de contingencia a realizar y las acciones concretas que lo componen, así mismo el calendario de ejecución de las obras y quienes son los responsables de ejecutarlas…”. Mediante oficio CMEOSA-OFI-0102-2019 del 12 de noviembre de 2019, Alexander Zúñiga Medina, en su condición de coordinador de la Unidad Gestión del Riesgo de Desastres de la Municipalidad de Osa, elaboró respuesta a la amparada, respecto a su gestión de fecha 28 de octubre de 2019.
Aunado a ello, por medio del escrito de fecha 13 de noviembre de 2020, dirigido al Consejo Municipal de Osa y al coordinador de la Comisión Nacional de Emergencias del Cantón de Osa, con fecha de recibido el 13 de noviembre de 2020, la tutelada manifestó lo que a continuación se transcribe: “…Estimado señor, en relación al peligro inminente de diferentes fenómenos pasados de la naturaleza. En el que se encuentra el barrio la laguna ubicada en distrito de Ciudad Cortés, por la indefensión del creciente avance del caudal del río Balzar, en época de ivierno, este año 2020 no fue la excepción con el Huracán ETA arrasando de gran magnitud mi propiedad y la de los vecinos aledaños, dejándonos totalmente en peligro notable. En reiteradas ocasiones hemos dado la voz de alerta por la crecida del caudal del río Balzar, a la Comisión Nacional de Emergencias. Solicitamos de la manera más respetuosa interponga sus buenos oficios a fin de concretar la realización de acciones puntuales en trabajos efectivos que protejan nuestras vidas de forma segura…”.
Se constata que el 16 de noviembre de 2020, según documento denominado “Solicitud de Primer Impacto o Emergencia No Declarada” se obtuvo 300 horas de maquinaria pesada (Tractor D8), mediante el cual se efectuaron trabajos de reencauzamiento del Rio Balzar. Se corrobora que debido a los daños provocados por tormenta tropical Nate al haber sido declarada emergencia, según decreto de emergencia N° 40677-MP, fue posible incluir dentro del Plan General de la Emergencia la situación acontecida en el Rio Balzar en el sector de Dirección01, para lo cual se gestionó con el MOPT, SENARA y la Municipalidad recurrida, en conjunto con la CNE un Plan de Inversión, en donde el SENARA funge como Unidad Ejecutora para las obras de protección requeridas, para lo cual se realizaron los diseños y se encuentra en fase de adjudicación de las obras según lo indica el expediente 2021CE-000036-0006500001 "Construcción de obras de protección en el río Grande de Térraba, sectores de Palmar Sur y Ciudad Cortés, cantón de Osa, Puntarenas”.
Estas obras incluyen, entre otros, el diseño y construcción de obras de protección en el sector del Dirección01 de Ciudad Cortés (obras que se espera ejecutar en el transcurso de la próxima estación seca en la zona). Además, el sector del barrio La Laguna se ha venido interviniendo con contrataciones por emergencia no declarada (primer impacto) solicitadas por la Municipalidad de Osa. Contrato que se tramitó en noviembre de 2020 y fue efectivo en enero de 2021, el cual consistió en 300 horas efectivas de un tractor tipo Caterpillar, modelo D8, según proceso de contratación 2021PI-000024-0006500001. Este tipo de obras corresponde a acciones correctivas para mitigar momentáneamente la problemática, dado su carácter de obra que se contrata de forma expedita, sin contar con estudios de mecánica fluvial. Estas acciones corresponden a obras rápidas para atenuar situaciones que se presentan por eventos locales.
Asimismo, el 14 de setiembre de 2021, se presentaron más afectaciones en Barrio La Laguna, en respuesta a ello y según consta en el informe de situación N° CMEOSA-INF N° 0037-2021, se practicaron las valoraciones correspondientes y se gestionó ante la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, la solicitud de 150 horas de tractor D8 para ampliar las labores de canalización y reencauzamiento, esta solicitud se encuentra en gestión administrativa en la CNE.
Si bien se logra demostrar que la Municipalidad de Osa ha realizado esfuerzos, a fin de paliar la situación descrita por la recurrente en su libelo de interposición, a la fecha de interposición de este amparo no consta que el ayuntamiento accionado brindara a una solución definitiva a la problemática expuesta. Así como tampoco, se comprueba que se le haya comunicado a la recurrente el oficio CMEOSA-OFI-0102-2019 del 12 de noviembre de 2019, elaborado en respuesta a la gestión presentada por la amparada en fecha 28 de octubre de 2019. Asimismo, no consta que se le haya dado respuesta a la petente, acerca de las gestiones planteadas en fechas 07 de febrero de 2018 y 13 de noviembre de 2020.
Por lo expuesto, lo procedente es declarar con lugar el recurso, en los términos que se indican en la parte dispositiva.
Refiere la recurrente que acudió tanto a la Municipalidad de Osa, como a la Comisión Nacional de Emergencias para que se le brinde una solución al problema de inundaciones en su propiedad y de la de sus vecinos, producto del desbordamiento del río Balzar.
Al respecto, no se acredita que alguna gestión haya sido presentada ante la Comisión Nacional de Emergencia, razón por la cual no puede atribuírsele la omisión en atender las solicitudes de fechas 07 de febrero de 2018, 28 de octubre de 2019 y 13 de noviembre de 2020. En todo caso, nótese que la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, en fechas 17 de agosto de 2018, 22 de agosto de 2019 y 16 de noviembre de 2020 efectuó las acciones necesarias a petición de la Municipalidad de Osa, para mitigar la afectación ocasionada por el caudal extraordinario provocado por el río Balzar en varias comunidades, entre ellas en Dirección04.
En consecuencia, en cuanto a este extremo, se declara sin lugar el recurso.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por la contaminación por inundaciones, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa la falta de las autoridades recurridas de tomar medidas como la limpieza de una quebrada, toda vez que produce inundaciones en la casa de habitación de la amparada, entre otros. En este sentido, esta omisión afecta la salud física y mental de la recurrente, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar parcialmente con lugar, difiero sobre dónde residenciar la fase de ejecución de la primera orden dada en la parte dispositiva, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso “que se brinde solución definitiva como corresponda a la problemática objeto de este recurso, todo dentro del plazo de DOCE MESES contado a partir de la notificación de esta sentencia”. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.
Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documento, ya sea en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente en contra de la Municipalidad de Osa. Se ordena Jorge Alberto Cole de León, Alfredo Soto Elizondo, Rodney Gamboa Carvajal y Jesús Mora Villalobos, por su orden alcalde, presidente del Concejo Municipal, director de la Unidad Técnica de Gestión Vial, y coordinador del Comité Municipal de Emergencias, o quienes en su lugar ejerzan esos cargos, girar las órdenes y realizar las coordinaciones necesarias dentro del ámbito de sus competencias, así como, con la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE), para que se brinde solución definitiva como corresponda a la problemática objeto de este recurso, todo dentro del plazo de DOCE MESES contado a partir de la notificación de esta sentencia. Asimismo, se le notifique a la amparada el oficio CMEOSA-OFI-0102-2019 del 12 de noviembre de 2019, elaboró en respuesta a la gestión presentada por el 28 de octubre de 2019.
Además, se brinde respuesta a las gestiones presentadas por la amparada en fechas 07 de febrero de 2018 y 13 de noviembre de 2020, lo anterior en un plazo de CINCO DÍAS, a partir de la notificación de esta sentencia. Se advierte al recurrido que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. En los demás extremos, se declara sin lugar el recurso. Se condena a la Municipalidad de Osa al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso.
El Magistrado Salazar Alvarado pone nota. La Magistrada Garro Vargas salva el voto respecto a la ejecución de la primera orden de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
