Post-judgment motion filed by [Nombre01 001], in relation to judgment n.° 2020-009220 of 9:15 hours on May 22, 2020.
Background:
SECOND: That by Resolution No. 1656-2020-TAA of thirteen hours and sixteen minutes on the twenty-ninth of May of two thousand twenty, this Tribunal resolved: "Sole [Finding]: On the basis of the reasoning set forth in the whereas clauses (Considerandos) of this Resolution, the complaint filed under expediente No. [Valor 001] is partially dismissed, in the sense that the aspect of the complaint alleging the purported illegal extraction of materials in the Canton of Puntarenas, District of Monteverde, approximately 26 kilometers from Dirección03 along the road to Monteverde passing through Sardinal, coordinates per Google Earth 10° 14.50.04" North, 84° 5029.48" West..." is dismissed (visible at folios 239 to 242) THIRD: That by Resolution No. 1657-2020-TAA of thirteen hours and twenty-one minutes on the twenty-ninth of May of two thousand twenty, the opening of ordinary administrative proceedings (procedimiento ordinario administrativo) was ordered and an oral and public hearing (audiencia oral y pública) was scheduled for September 16, 2020.

SEVENTH: That at folios 586 to 588 of the administrative file there is a written submission of closing arguments filed on November 9, 2020 by Lic. Sebastián Calderón Cerdas, on behalf of Mr. [Nombre01 001].
EIGHTH: That at folios 589 to 604 of the administrative file there is a written submission of closing arguments filed on November 9, 2020 by Mr. Nombre03, in his capacity as Special Administrative Attorney-in-Fact (Apoderado Especial Administrativo) of the Consejo Nacional de Viabilidad.

SEVENTEENTH: That by Resolution 1266-2021-TAA dated September 27, 2021, folios 643 to 646, this Tribunal resolved: "...as evidence for better deciding the case (prueba para mejor resolver), orders the following to be requested: 1. From Mr. Alexander Solís Delgado, in his capacity as Executive President of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, or whoever holds his position: a. Whether the construction and/or expansion and/or improvement of National Route 606, Guacimal – Santa Elena section, falls within the scope established by Decreto Ejecutivo 36201-MP dated September 30, two thousand ten, as amended by Decreto Ejecutivo No. 36426-MP dated December 17, two thousand ten, or by Decreto Ejecutivo No. 37305-MP of September 24, 2012; and if so: i. Whether the construction and/or expansion and/or improvement of National Route 606, Guacimal – Santa Elena section, is included in the General Emergency Plan, as indicated in Article 3 of the aforementioned executive decrees. ii.
What types of works were permitted in the development of this project. iii. What was the timeline for the works, including start and completion dates. iv. Whether the said works were required to be concluded before the declaration of cessation of the state of emergency under the aforementioned Executive Decrees. v. Any other data or information of interest. The foregoing within a period of three business days counted from the next business day following notification of this resolution. 2. From MSC. Cynthia Barzuna, in her capacity as General Secretary of SETENA, or whoever holds her position, to report: a. Whether activities falling within the scope of a National Emergency Decree are exempt from the environmental impact assessment (evaluación de impacto ambiental) process. If so: i. Whether the Improvement Project for National Route 606, Guacimal – Santa Elena section, file D1-402-2008-SETENA, in accordance with Resolution No. 2629-2013-SETENA, is exempt from submitting the environmental impact assessment process. ii.
Whether the Improvement Project for National Route 606, Guacimal – Santa Elena section, file D1-402-2008-SETENA, had an environmental impact assessment approved by SETENA. iii. Any other data or information of interest. The foregoing within a period of three business days counted from the next business day following notification of this resolution (…)
That this Office considers it important to bring to the attention of the Honorable Constitutional Chamber that for the year 2021 this Tribunal has a new composition of its judiciary, covering the period from 2021 to 2026 (for a term of 6 years). That with respect to the contempt motion filed by Mr. [Nombre01 001], it is important to note that this Tribunal, by Resolution 1657-2020-TAA, folios 256 to 259, in its fifth whereas clause (considerando quinto), responded to the written submission filed by Mr. [Nombre01 001] dated March 10, 2020. As for the issuance of the final act (acto final), as can be seen from Resolution No. 1266-2021-TAA dated September 27, 2021, issued by the new judiciary, this Tribunal deemed it appropriate to have elements that would allow it to clarify the true facts of the matter for the purpose of issuing the final resolution in administrative expediente No. [Valor 001], and therefore requested, as evidence for better deciding the case, reports from Mr.
Alexander Solís Delgado, in his capacity as Executive President of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, and from MSc. Cynthia Barzuna Gutiérrez, in her capacity as General Secretary of SETENA, information which is relevant and important for resolving the present administrative file. For the foregoing reasons, and given the urgency of resolving this file, a period of three business days was granted to the institutions to submit their responses. For the foregoing reasons, the Honorable Constitutional Chamber is respectfully requested to grant an extension of time for the purpose of complying with Resolution No. 2020009220 issued by the same Chamber, since, as stated above, it is of the utmost importance to have the requested documentary evidence. As soon as this Tribunal has the pertinent information, it will proceed to issue a resolution in accordance with the applicable law for the matter at hand, and the Chamber will be duly informed thereof. By virtue of the foregoing, and once the resolution has been issued and the corresponding final act of the proceeding has been handed down, the Constitutional Chamber will be so informed."
This opinion is drafted by Magistrado Delgado Faith; and,
Considering:
"The writ (recurso) is granted. Maricé Navarro Montoya, in her capacity as President of the Tribunal Ambiental Administrativo, or whoever holds that position in her place, is ordered to take the necessary steps within the scope of her authority so that, within 5 days counted from notification of this ruling, she responds as the law requires and delivers the information requested by the petitioner (recurrente) in the submission of March 10, 2020. Furthermore, she must carry out the pertinent coordination and take the necessary steps within the scope of her authority so that, within 4 months counted from notification of this ruling, the final administrative act is issued and rendered with respect to the complaints processed in administrative file No. [Valor 001]. All of the foregoing is issued with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, a prison sentence (pena de prisión) of three months to two years or a day-fine (día multa) of twenty to sixty days shall be imposed on whoever receives an order from this Chamber that they are required to comply with or enforce and fails to observe it, provided the offense is not subject to a more severe penalty.
The State is ordered to pay costs, damages, and losses (costas, daños y perjuicios) caused by the acts underlying this declaration, which shall be determined in the enforcement of judgment (ejecución de sentencia) proceedings before the administrative litigation court. Notice is hereby given. Magistrado Salazar Alvarado issues a partial dissent and votes to deny the writ with respect to the alleged violation of the right to a healthy and ecologically balanced environment." Said ruling was notified to the respondent authority on May 26, 2020.
In the sub examine, the petitioner files a motion for contempt (gestión de desobediencia) with respect to judgment No. 2020-009220 issued at 9:15 a.m. on May 22, 2020. The petitioner alleges that the Chamber ordered the Tribunal Ambiental Administrativo to resolve administrative file [Valor 001], corresponding to the reconstruction of Dirección01. The petitioner further alleges that the time period granted has already elapsed without the respondent tribunal having resolved said file. The petitioner requests that the corresponding sanctions be imposed.
That said, the Chamber notes that in judgment No. 2020-009220 issued at 9:15 a.m. on May 22, 2020, various orders were issued, namely: "that within 5 days counted from notification of this ruling, she responds as the law requires and delivers the information requested by the petitioner in the submission of March 10, 2020. Furthermore, she must carry out the pertinent coordination and take the necessary steps within the scope of her authority so that, within 4 months counted from notification of this ruling, the final administrative act is issued and rendered with respect to the complaints processed in administrative file No. [Valor 001]"; however, in the sub examine, the moving party (gestionante) filed the motion for contempt solely with respect to the order concerning "Furthermore, she must carry out the pertinent coordination and take the necessary steps within the scope of her authority so that, within 4 months counted from notification of this ruling, the final administrative act is issued and rendered with respect to the complaints processed in administrative file No. [Valor 001]," and therefore the analysis is limited to the moving party's claim.
To clarify the foregoing, the Chamber notes that after the authorities were notified of ruling No. 2020-009220 issued at 9:15 a.m. on May 22, 2020 — which occurred on May 26, 2020 — the Tribunal Ambiental Administrativo, by resolution No. 1656-2020-TAA of May 29, 2020, resolved: "On the basis of the Recitals of this Resolution, the complaint filed in administrative file No. [Valor 001] is partially dismissed, in the sense that the portion of the complaint alleging the purported illegal extraction of materials in the Cantón Puntarenas, Distrito Monteverde, 26 kilometers from the intersection of Dirección04 with the road to Monteverde that passes through Sardinal, at coordinates per Google Earth 10°14'50.04 North, 84°50'29.48 West, is dismissed." That resolution was notified to the protected party (tutelado) on June 3, 2020.
Likewise, by administrative resolution No. 1657-2020-TAA of May 29, 2020, the Tribunal Ambiental Administrativo convened the parties to the oral and public hearing (audiencia oral y pública) scheduled for September 16, 2020, which was notified to the claimant (accionante) on June 3, 2020. Subsequently, by resolution No. 2417-2020-TAA of August 28, 2020, the Tribunal Ambiental Administrativo suspended the hearing scheduled for September 16, 2020 and rescheduled it to November 4, 2020. That resolution was notified to the protected party on September 15, 2020.
Subsequently, the oral and public hearing was held on November 4, 2020. On November 9, 2020, the parties to the proceedings submitted their respective closing arguments (conclusiones). On November 26 and December 8, 2020, as well as January 9, March 16, and July 28, 2021, the Asociación Conservacionista Guacimal, Santa Elena y Monteverde submitted written briefs to the file.
On the other hand, the Chamber notes that while the oral and public hearing was held on November 4, 2020, and the parties submitted their closing arguments in writing as early as November 9, 2020, it was not until September 27, 2021 — at the contempt hearing — that the Tribunal Ambiental Administrativo concluded that it was necessary to request evidence for better adjudication and, accordingly, by resolution No. 1266-2021-TAA of September 27, 2021, it requested: "1. From Mr. Alexander Solís Delgado, in his capacity as Executive President of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, or whoever holds that position: a. Whether the construction and/or expansion and/or improvement of Ruta Nacional 606, section Guacimal – Santa Elena, is covered by Decreto Ejecutivo 36201-MP dated September 30, 2010, as amended by Decreto Ejecutivo No. 36426-MP dated December 17, 2010, or by Decreto Ejecutivo No. 37305-MP of September 24, 2012, and if so, to indicate: i. Whether the construction and/or expansion and/or improvement of Ruta Nacional 606, section Guacimal – Santa Elena, is included in the General Emergency Plan (Plan General de Emergencia), as provided in Article 3 of the cited executive decrees. ii.
What type of works were permitted in the development of this project. iii. What was the timeline for carrying out the works, including the start and end dates. iv. Whether the aforementioned works were required to be completed before the declaration of cessation of the state of emergency under the cited Executive Decrees. v. Any other data or information of interest. The foregoing within a period of three business days counted from the next business day following notification of this resolution. 2. From MSc. Cynthia Barzuna, in her capacity as General Secretary of SETENA, or whoever holds that position, to report: a. Whether activities falling within the scope of a National Emergency Decree are excluded from the environmental impact assessment (Evaluación de Impacto Ambiental) process. If so: i. Whether the project for the Improvement of Ruta Nacional 606, section Guacimal – Santa Elena, file D1-402-2008-SETENA, pursuant to Resolution No. 2629-2013-SETENA, is excluded from submitting the environmental impact assessment process. ii.
Whether the project for the Improvement of Ruta Nacional 606, section Guacimal – Santa Elena, file D1-402-2008-SETENA, had an environmental impact assessment approved by SETENA. iii. Any other data or information of interest. The foregoing within a period of three business days counted from the next business day following notification of this resolution." From this standpoint, the Court observes that the deadline ordered for the Tribunal Ambiental Administrativo to resolve the complaints processed in administrative case file n.° [Valor 001] expired in September 2020; however, it was not until September 2021—nearly a year after the expiration of the deadline set by this Court and more than ten months after the oral and public hearing (audiencia oral y pública) was held—that the Tribunal Ambiental Administrativo saw fit to request additional evidence for the purpose of better deciding the case, and as of the date of this decision there is no record that a final ruling (acto final) has been issued.
Therefore, the Court finds a gross failure to act on the part of the respondent authority in complying with the provisions of ruling (sentencia) n.° 2020-009220 of 9:15 a.m. on May 22, 2020, specifically with respect to the following provision: "Furthermore, it shall make the appropriate arrangements and take the necessary steps within the scope of its jurisdiction, so that within a period of 4 months, counted from the notification of this ruling, a final ruling shall be issued and rendered with respect to the complaints processed in administrative case file n.° [Valor 001]," and therefore this Court finds the alleged non-compliance to be established.
For the reasons set forth above, the request for an extension (prórroga) submitted by the respondent authority at the non-compliance hearing (audiencia de desobediencia) is inadmissible, since it was filed nearly a year after the deadline originally set by the Court had expired, and following a period of inactivity by the Tribunal Ambiental Administrativo with respect to case file n.° [Valor 001].
Consequently, the request for a deadline extension submitted by the Tribunal Ambiental Administrativo is denied, and the non-compliance motion (gestión de desobediencia) is granted in the terms to be set forth in the operative part (parte dispositiva) of this ruling.
Furthermore, given that the person currently holding the position of president of the Tribunal Ambiental Administrativo is Adriana Bejarano Alfaro, and not Maricé Navarro Montoya, to whom the order was issued in ruling n.° 2020-009220 of 9:15 a.m. on May 22, 2020, it is appropriate to direct compliance with the provisions of that ruling to the person currently holding that position.
The parties are hereby notified that any paper documents they may have submitted, as well as objects or evidence contained on any additional device of an electronic, computer-based, magnetic, optical, telematic, or new-technology nature, must be retrieved from the court office within a maximum period of 30 business days counted from the notification of this ruling. Otherwise, all material not retrieved within that period will be destroyed, pursuant to the provisions of the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in session N° 27-11 of August 22, 2011, artículo XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in session N° 43-12 held on May 3, 2012, artículo LXXXI.
Por tanto:
The non-compliance motion filed in connection with ruling n.° 2020-009220 of 9:15 a.m. on May 22, 2020, is partially granted with respect to the following provision: "Furthermore, it shall make the appropriate arrangements and take the necessary steps within the scope of its jurisdiction, so that within a period of 4 months, counted from the notification of this ruling, a final ruling shall be issued and rendered with respect to the complaints processed in administrative case file n.° [Valor 001]." Adriana Bejarano Alfaro, in her capacity as president of the Tribunal Ambiental Administrativo, or whoever may hold that position in her place, is hereby ordered to immediately comply with the provisions of ruling n.° 2020-009220 of 9:15 a.m. on May 22, 2020, specifically: "Furthermore, it shall make the appropriate arrangements and take the necessary steps within the scope of its jurisdiction, so that within a period of 4 months, counted from the notification of this ruling, a final ruling shall be issued and rendered with respect to the complaints processed in administrative case file n.° [Valor 001]." The respondent is hereby warned that, pursuant to artículo 71 of the Ley de la Jurisdicción Constitucional, a sentence of three months to two years of imprisonment, or a fine of twenty to sixty days, shall be imposed on any person who receives an order—issued in a writ of amparo (recurso de amparo)—that they are required to comply with or enforce, and fails to comply with or enforce it, provided the offense is not subject to a more severe penalty.
In all other respects, the motion is denied. This resolution shall be personally served upon Adriana Bejarano Alfaro, in her capacity as president of the Tribunal Ambiental Administrativo, or upon whoever may hold that position in her place.

Gestión posterior planteada por [Nombre01 001], en relación con la sentencia n.° 2020-009220 de las 9:15 horas del 22 de mayo de 2020.
Resultando:
Redacta el Magistrado Delgado Faith; y,
Considerando:
“Se declara con lugar el recurso. Se le ordena a Maricé Navarro Montoya, en su condición de Presidenta del Tribunal Ambiental Administrativo, o a quien en su lugar ocupe el cargo, que realice las gestiones necesarias dentro del ámbito de sus competencias, a efectos de que dentro del plazo de 5 días, contado a partir de la notificación de este pronunciamiento, conteste lo que en derecho corresponde y entregue la información solicitada por el recurrente en la gestión del 10 de marzo de 2020. Además, deberá efectuar las coordinaciones pertinentes y realizar las gestiones necesarias dentro del ámbito de sus competencias, a efectos de que dentro del plazo de 4 meses, contado a partir de la notificación de este pronunciamiento, se resuelva y dicte el acto final respecto a las denuncias tramitadas en el expediente administrativo n.° [Valor 001]. Todo lo anterior se dicta con la advertencia que de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá pena de prisión de tres meses a dos años o de veinte a sesenta día multa a quien reciba una orden de esta Sala que deba cumplir o hacer cumplir y la inobserve, siempre que el delito no esté más gravemente penado.
Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese. El Magistrado Salazar Alvarado salva el voto en forma parcial y declara sin lugar el recurso, en cuanto a la acusada violación del derecho a un ambiente sano y ecológicamente equilibrado”.
Tal pronunciamiento fue notificado a la autoridad recurrida el 26 de mayo de 2020.
En el sub examine, el recurrente plantea gestión de desobediencia en relación con la sentencia n.° 2020-009220 de las 9:15 horas del 22 de mayo de 2020. Recrimina que la Sala le ordenó al Tribunal Ambiental Administrativo que resolviera el expediente [Valor 001], correspondiente a la reconstrucción de la Dirección01. Recrimina que ya ha transcurrido el plazo otorgado, sin que el tribunal accionado haya resuelto el citado expediente. Solicita que se apliquen las sanciones correspondientes.
Ahora bien, la Sala observa que en la sentencia n.° 2020-009220 de las 9:15 horas del 22 de mayo de 2020, se emitieron diversas órdenes, a saber: “que dentro del plazo de 5 días, contado a partir de la notificación de este pronunciamiento, conteste lo que en derecho corresponde y entregue la información solicitada por el recurrente en la gestión del 10 de marzo de 2020. Además, deberá efectuar las coordinaciones pertinentes y realizar las gestiones necesarias dentro del ámbito de sus competencias, a efectos de que dentro del plazo de 4 meses, contado a partir de la notificación de este pronunciamiento, se resuelva y dicte el acto final respecto a las denuncias tramitadas en el expediente administrativo n.° [Valor 001]”; empero, en el sub examine, el gestionante solo formuló la gestión de desobediencia en relación con la orden concerniente a “Además, deberá efectuar las coordinaciones pertinentes y realizar las gestiones necesarias dentro del ámbito de sus competencias, a efectos de que dentro del plazo de 4 meses, contado a partir de la notificación de este pronunciamiento, se resuelva y dicte el acto final respecto a las denuncias tramitadas en el expediente administrativo n.° [Valor 001] ”, por lo que el análisis se circunscribe a la pretensión del gestionante.
Aclara lo anterior, la Sala observa que con posterioridad a que las autoridades fueran notificadas del pronunciamiento n.° 2020-009220 de las 9:15 horas del 22 de mayo de 2020 (hecho que acaeció el 26 de mayo de 2020), el Tribunal Ambiental Administrativo, mediante resolución n.° 1656-2020-TAA del 29 de mayo de 2020 resolvió: “Con fundamento en los Considerandos de esta Resolución, se desestima parcialmente la denuncia tramitada en el expediente N° [Valor 001] , en el sentido de que se desestima el aspecto de la denuncia que alega la supuesta extracción ilegal de materiales en el Cantón Puntarenas, Distrito Monteverde, a 26 kilómetros del Cruce de la Dirección04 con el camino a Monteverde que pasa por Sardinal, coordenadas según Google Earth 10°14’50.04 Norte, 84°50’29.48 Oeste ”. Tal resolución fue notificada al tutelado del 3 de junio de 2020.
Asimismo, por resolución administrativa n.° 1657-2020-TAA del 29 de mayo de 2020, el Tribunal Ambiental Administrativo convocó a las partes a la audiencia oral y pública, programada para el 16 de setiembre de 2020, situación que le fue notificada al accionante el 3 de junio de 2020. Posteriormente, por resolución n.° 2417-2020-TAA del 28 de agosto de 2020, el Tribunal Ambiental Administrativo suspendió la audiencia programada para el 16 de setiembre de 2020 y la reprogramó para el 4 de noviembre de 2020. Tal resolución fue notificada al tutelado el 15 de setiembre de 2020.
Posteriormente, el 4 de noviembre de 2020 se celebró la audiencia oral y pública. El 9 de noviembre de 2020, las partes del procedimiento aportaron las conclusiones respectivas. El 26 de noviembre y 8 de diciembre de 2020, así como el 9 de enero, 16 de marzo y 28 de julio de 2021, la Asociación Conservacionista Guacimal, Santa Elena y Monteverde aportó escritos al expediente.
De otra parte, la Sala observa que si bien la audiencia oral y pública fue celebrada el 4 de noviembre de 2020 y las partes rindieron las conclusiones por escrito desde el 9 de noviembre de 2020, no menos cierto es que no fue sino hasta el 27 de setiembre de 2021 (con ocasión de la audiencia de desobediencia), que el Tribunal Ambiental Administrativo consideró que era necesario solicitar prueba para mejor resolver y por ello, mediante resolución n.° 1266-2021-TAA del 27 de setiembre de 2021 solicitó: “1. al Sr. Alexander Solís Delgado, en su condición de Presidente Ejecutivo de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias o a quien ocupe su cargo: a. Si la construcción y/o ampliación y/o mejoramiento de la Ruta Nacional 606, sección Guacimal - Santa Elena, se encuentra amparada dentro de lo establecido en el Decreto Ejecutivo 36201-MP de fecha 30 de setiembre de dos mil diez, modificado mediante Decreto Ejecutivo No. 36426-MP de fecha 1 7 de diciembre de dos mil diez, o en el Decreto Ejecutivo No. 37305-MP del 24 de setiembre de 2012, en caso afirmativo indicar: i. Si la construcción y/o ampliación y/o mejoramiento de la Ruta Nacional 606, sección Guacimal - Santa Elena, consta dentro del Plan General de Emergencia, así como lo indica el artículo 3 de los citados decretos ejecutivos. ii.
Que (sic) tipo de obras se encontraban permitidas en el desarrollo de este proyecto. iii. Cuál era el plazo para desarrollar las obras, inicio y finalización iv. Si la citada obra debia (sic) concluir antes de la declaración de cesación del estado de emergencia de los citados Decretos Ejecutivos. v. Cualquier otro dato o información de interés. Lo anterior en el plazo de tres días hábiles contados a partir del día siguiente hábil a la notificación de la presente resolución. 2. A la MSC. Cynthia Barzuna, en su condición de Secretaria General de SETENA o a quien ocupe su cargo que informe: a. Si las actividades que se encuentran enmarcadas dentro de un Decreto de Emergencia Nacional, se excluyen del trámite de Evaluación de Impacto Ambiental. En caso afirmativo: i. Si el proyecto de Mejoramiento de la Ruta Nacional 606, sección Guacimal - Santa Elena, expediente D1-402-2008-SETENA, de conformidad con la Resolución No. 2629-2013-SETENA, se encuentra excluida de presentar el trámite de Evaluación de Impacto Ambiental. ii.
Si el Proyecto Mejoramiento de la Ruta Nacional 606, sección Guacimal Santa Elena, expediente D1-402-2008-SETENA, contaba con Evaluación de Impacto Ambiental, aprobada por SETENA. iii. Cualquier otro dato o información de interés. Lo anterior en el plazo de tres días hábiles contados a partir del día siguiente hábil a la notificación de la presente resolución ”.
Desde este panorama, la Sala observa que el plazo ordenado al Tribunal Ambiental Administrativo para resolver las denuncias tramitadas en el expediente administrativo n.° [Valor 001] feneció en setiembre de 2020; empero, no fue sino hasta setiembre de 2021, transcurrido casi un año desde el vencimiento del plazo otorgado por este Tribunal y tras más de diez meses de celebrada la audiencia oral y pública, que el Tribunal Ambiental Administrativo estimó conveniente solicitar prueba para mejor resolver, por lo que a la fecha no consta que se haya dictado el acto final. Ergo, la Sala constata una grosera inacción de parte de la autoridad recurrida en darle cumplimiento a lo dispuesto en la sentencia n.° 2020-009220 de las 9:15 horas del 22 de mayo de 2020, en lo atinente a “Además, deberá efectuar las coordinaciones pertinentes y realizar las gestiones necesarias dentro del ámbito de sus competencias, a efectos de que dentro del plazo de 4 meses, contado a partir de la notificación de este pronunciamiento, se resuelva y dicte el acto final respecto a las denuncias tramitadas en el expediente administrativo n.° [Valor 001]”, de ahí que este Tribunal acredite el incumplimiento acusado.
Por las razones esbozadas, es que resulta improcedente la solicitud de prórroga formulada por la autoridad accionada con ocasión de la audiencia de desobediencia, toda vez que la misma fue formulada casi un año después de fenecido el plazo originalmente otorgado por la Sala y tras un plazo de inactividad del Tribunal Ambiental Administrativo en relación con el expediente n.° [Valor 001] .
En consecuencia, se desestima la solicitud de prórroga de plazo solicitada por el Tribunal Ambiental Administrativo y se acoge la gestión de desobediencia en los términos que se dirán en la parte dispositiva de este pronunciamiento.
Ahora bien, visto que la persona que actualmente ocupa el cargo de presidenta del Tribunal Ambiental Administrativo es Adriana Bejarano Alfaro y no Maricé Navarro Montoya, a quien se le emitió la orden en la sentencia n.° 2020-009220 de las 9:15 horas del 22 de mayo de 2020, lo procedente es ordenar el cumplimiento de lo ahí dispuesto a la actual persona que ocupa el cargo.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se acoge parcialmente la gestión de desobediencia formulada en relación con la sentencia n.° 2020-009220 de las 9:15 horas del 22 de mayo de 2020, en lo atinente a “Además, deberá efectuar las coordinaciones pertinentes y realizar las gestiones necesarias dentro del ámbito de sus competencias, a efectos de que dentro del plazo de 4 meses, contado a partir de la notificación de este pronunciamiento, se resuelva y dicte el acto final respecto a las denuncias tramitadas en el expediente administrativo n.° [Valor 001]”. Se ordena a Adriana Bejarano Alfaro, en su condición de presidenta del Tribunal Ambiental Administrativo, o a quien en su lugar ocupe ese cargo, el cumplimiento inmediato de lo dispuesto en la sentencia n.° 2020-009220 de las 9:15 horas del 22 de mayo de 2020, en lo atinente a “ Además, deberá efectuar las coordinaciones pertinentes y realizar las gestiones necesarias dentro del ámbito de sus competencias, a efectos de que dentro del plazo de 4 meses, contado a partir de la notificación de este pronunciamiento, se resuelva y dicte el acto final respecto a las denuncias tramitadas en el expediente administrativo n.° [Valor 001] ”.
Se advierte al recurrido que, según los términos del artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. En todo lo demás, no ha lugar a la gestión formulada. Notifíquese esta resolución a Adriana Bejarano Alfaro, en su condición de presidenta del Tribunal Ambiental Administrativo, o a quien en su lugar ocupe ese cargo, en forma personal.
