Contempt motion (gestión de desobediencia) in the writ of amparo (recurso de amparo) proceeding filed under case number 20-007376-0007-CO, brought by [Nombre01 001], national identity document [CED01], and [Nombre01 002], national identity document [CED02], against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA) AND THE ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE TIERRA BLANCA.

Background:

By Ruling No. 2020-10200 of 09:10 hours on June 5, 2020, this Chamber partially granted the writ of amparo, solely against ICAA, in the following terms:

"The writ of amparo is granted, solely, against the Instituto Costarricense de Acueductos y Alcantarillados. Manuel Antonio Salas Pereira, in his capacity as General Manager, and Cecilia Martínez Artavia, in her capacity as Deputy Manager for Community Systems Management (Subgerente de Gestión de Sistemas Comunales), both of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds those positions, are ordered to take all actions within the scope of their authority so that, within a period of THREE MONTHS counted from the notification of this ruling, they proceed to provide a solution for the aqueduct located in Tierra Blanca, Nicoya, Nicoya, Guanacaste, with the purpose of legally regularizing the provision of the service. They shall take the necessary measures to ensure that services are not suspended to the communities that currently receive them. Likewise, once the legal status of the aqueduct has been defined, the governing authority (Ente Rector) must assess the application submitted by the petitioner within the statutory deadline.

It is hereby noted that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, a prison sentence of three months to two years, or a fine of twenty to sixty days, shall be imposed on anyone who receives an order that they must comply with or enforce, issued within a writ of amparo proceeding, and fails to comply with or enforce it, provided the offense is not more severely punishable under another provision. The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay costs, damages, and losses caused by the acts that form the basis of this declaration, which shall be liquidated in enforcement-of-judgment proceedings—the first before the civil jurisdiction, and the second before the administrative litigation jurisdiction (lo contencioso administrativo). Notify." On June 9, 2020, ICAA was notified of Ruling No. 2020-10200 of 09:10 hours on June 5, 2020.

By Ruling No. 2020-17650 of 09:20 hours on September 18, 2020, this Constitutional Tribunal resolved the following: "The material error contained in the operative clause (parte dispositiva) of Ruling 2020-10200 of 09:10 hours on June 5, 2020, is corrected ex officio, so that it is understood that the award of costs in this writ of amparo falls solely against the Instituto Costarricense de Acueductos y Alcantarillados, and that any enforcement proceedings must be resolved before the administrative litigation jurisdiction. Regarding the request for an extension of time (ampliación de plazo), Manuel Antonio Salas Pereira, in his capacity as General Manager, and Cecilia Martínez Artavia, in her capacity as Deputy Manager for Community Systems Management, both of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds those positions, are granted a period of EIGHT MONTHS, counted from the date of the request (September 10, 2020), in order to fully comply with what was ordered by this Chamber in Ruling No. 2020-10200 of 09:10 hours on June 5, 2020. Notify." By written submission received on September 20, 2021, the petitioner filed a contempt motion regarding what was ordered by this Constitutional Chamber in Ruling No. 2020-10200 of 09:10 hours on June 5, 2020, and Ruling No. 2020-17650 of 09:20 hours on September 18, 2020.

By resolution of 16:59 hours on September 22, 2021, Justice Salas Torres granted an opportunity to be heard to Manuel Antonio Salas Pereira, in his capacity as General Manager, and Cecilia Martínez Artavia, in her capacity as Deputy Manager for Community Systems Management, both of ICAA, or whoever holds those positions, to respond and submit the corresponding evidence regarding the acts and omissions attributed to them.

Tomás Francisco Martínez Balladares, in his capacity as Executive President of ICAA, reports under oath as follows:

"By memorandum No. GSP-RCHO-2021-03138 dated September 28, 2021 (see Exhibit No. 1), the Engineering Division of the Chorotega Regional Directorate reported on the progress and actions taken regarding the Tierra Blanca de Nicoya, Guanacaste aqueduct and stated: Progress. Among the main actions and resources deployed, noteworthy progress has been made on the Project for the replacement of pipes with larger-diameter pipes in the Polvazales aqueduct, aimed at resolving and improving the hydraulic capacity (capacidad hidráulica) and operational conditions of the aqueduct, with a view to supplying and connecting the Tierra Blanca aqueduct. The project has reached 100% completion in terms of designs, technical specifications, terms of reference, environmental feasibility, and budget approval; it consists of the construction of 800 linear meters of PVC SDR26 pipe with a 100 mm diameter, including the construction of 10 residential service connections (previstas domiciliares), an interconnection, valves, and relocation of new residential service connections to the existing water meter (hidrómetro).

Also included is the construction of 3 interconnections between the new pipe and the existing pipe, and 3 disconnections of the existing pipes to be replaced. The project budget is 18 million colones. The project is currently in the process of being registered and published on SICOP, and it is expected to be awarded and executed within the coming months. In addition to the above, work is also underway to acquire the materials and equipment required for the construction of 400 linear meters of pipeline between the Polvazales and Tierra Blanca aqueducts, using AyA's own resources. The permitting process and study of the well that currently supplies the Polvazales system are also underway for its imminent operation by AyA, including disinfection and water quality monitoring." From the above, the progress on the project for the replacement of pipes—and thereby the improvement of the hydraulic capacity and operational conditions of the Polvazales aqueduct and the connection of the Tierra Blanca de Nicoya system—is evident.

Furthermore, the aforementioned memorandum states: Key Milestones. Under code BPIP 002992, the project for the purchase of pipes needed to connect the Tierra Blanca Aqueduct with the Polvazales Aqueduct was successfully incorporated and registered with the planning authority; however, the necessary financial resources were not secured due to budget cuts unrelated to operational management, since budgetary allocations do not depend on this region as an operational unit. What was described in the preceding paragraph affected the established timelines for incorporating additional water into the Tierra Blanca de Nicoya system and subsequently considering the approval of new connections to the affected system; nonetheless, as described in the preceding paragraphs, efforts continued to be made to achieve the proposed goal, at the expense of other important projects for the systems operated by AyA in the Chorotega Region.

It is important to note that the ASADA Tierra Blanca is currently providing continuous and uninterrupted service to its existing users (with AyA's operational support); however, due to water supply (oferta hídrica) conditions, it is not possible to add new connections until the improvements described in this report have been completed. In the present case, the current users of the system operated by the ASADA de Tierra Blanca de Nicoya receive continuous and uninterrupted service with AyA's operational support, and the interconnection with the Polvazales system is being awaited, for which the installation of the pipeline is required—already requested under code BPIP 002992, having been incorporated and registered with the planning authority—and it is expected that by January 30, 2022, the situation will be resolved and new certificates of service availability (constancias de disponibilidad de servicio) can be issued.

Voto N° 2020-010200 of nine hours ten minutes on June fifth, two thousand twenty orders AyA to: 1. Legally regularize the provision of the service provided by the ASADA de Tierra Blanca de Nicoya. 2. Ensure that services are not suspended to the communities that currently receive them. 3. Once the legal status of the aqueduct has been defined, assess the application submitted by the petitioners. As previously stated, AyA is providing operational support to the ASADA de Tierra Blanca de Nicoya, which is why the service has not been suspended; on the contrary, it is continuous and uninterrupted. With respect to the legal situation, once the pipeline has been installed and the interconnection with the Polvazales system has been achieved, AyA will directly take over the operation of the aqueduct in order to legalize the provision of the service. Finally, it is expected that by January 30, 2022, this interconnection will have been completed, thus enabling analysis of the petitioners' request, which does not depend on the legal status of the ASADA Tierra Blanca de Nicoya, but rather on prior verification of water capacity, since it is reiterated that there are water resource shortages arising from force majeure (fuerza mayor) that are beyond AyA's control." By a certification dated October 5, 2021, the Secretariat of the Constitutional Chamber certified that "it did not appear that, from September 23 to October 4, 2021, the General Manager and the Deputy Manager for Community Systems Management, both of the Instituto Costarricense de Acueductos y Alcantarillados, had submitted any written document or filing in order to render the report requested of them in the resolution issued at sixteen hours fifty-nine minutes on September twenty-second, two thousand twenty-one, in case number 20-007376-0007-CO, which is a WRIT OF AMPARO brought by [Nombre01 001], [Nombre01 002]." The legal requirements (prescripciones legales) have been observed in the proceedings conducted.

The opinion is drafted by Justice Garro Vargas; and,

Considering:

SINGLE. REGARDING THE ALLEGED CONTEMPT. By written submission received on September 20, 2021, petitioner [Nombre01 002] filed a contempt motion regarding what was ordered by this Constitutional Chamber in Ruling No. 2020-10200 of 09:10 hours on June 5, 2020, and Ruling No. 2020-17650 of 09:20 hours on September 18, 2020. In the submission, the petitioner stated that the additional eight-month period granted in Ruling No. 2020-17650 had already expired and that ICAA had not provided a solution to allow the construction of residential homes.

However, in the report submitted by the Executive Presidency of ICAA, it was noted that by memorandum No. GSP-RCHO-2021-03138 dated September 28, 2021, the Engineering Division of the Chorotega Regional Directorate reported on the progress and actions taken regarding the Tierra Blanca de Nicoya, Guanacaste aqueduct and recorded the following:

"Progress. Among the principal actions and resources employed, the progress made on the Pipeline Replacement Project for larger diameters in the Polvazales water supply system (acueducto) is noteworthy; the project is aimed at resolving and improving the hydraulic capacity and operating conditions of that water supply system in order to supply and connect the Tierra Blanca water supply system. The project has reached 100% completion in designs, technical specifications, terms of reference, environmental feasibility, and budget approval. It consists of the construction of 800 linear meters (ml) of PVC SDR26 pipe with a diameter of 100 mm, including the construction of 10 household service connections (previstas domiciliares), interconnections, valves, and the relocation of new household service connections to the existing water meter (hidrómetro). It also includes the construction of 3 interconnections between the new pipe and the existing pipe, and 3 disconnections of existing pipes to be replaced.

The project budget is 18 million colones. Registration and publication of the aforementioned project in SICOP is currently under way, and the project is expected to be awarded and executed in the coming months. In addition, work is also under way on the procurement of materials and equipment required for the construction of 400 linear meters of pipe between the Polvazales and Tierra Blanca water supply systems, using AYA's own resources. Also in progress are the permit process and study of the well that currently supplies the Polvazales system, for its imminent operation by AYA, including disinfection and water-quality monitoring" (emphasis not in the original).

Likewise, the memorandum submitted as evidence by ICAA recorded the progress of the project for the replacement of pipes and, thereby, the improvement of the hydraulic capacity and operating conditions of the Polvazales water supply system and the connection of the Tierra Blanca de Nicoya system. The following was recorded in that official letter:

"Under code BPIP 002992, it was possible to incorporate and register with the planning office the project for the purchase of pipes needed for the connection of the Acueducto de Tierra Blanca with the Acueducto de Polvazales; however, the necessary financial resources could not be secured due to budget cuts beyond the control of the operational management, since budget allocations do not depend on this region as an operational area. What was described in the preceding paragraph affected the established timelines for incorporating additional water into the Tierra Blanca de Nicoya system and subsequently considering the approval of new service connections to the affected system; nevertheless, as described in the preceding paragraphs, efforts continued to be made to achieve the proposed objective, at the expense of other important projects for the systems operated by AyA in the Chorotega Region" (emphasis not in the original).

Finally, the representative of ICAA indicated that what the Chamber had ordered sought to: "1. Legally regularize the provision of the service rendered by the ASADA of Tierra Blanca de Nicoya. 2. Ensure that services are not suspended for the communities currently receiving them. 3. Once the legal status of the water supply system is determined, evaluate the petition submitted by the appellants." It was also indicated that ICAA is providing operational support to the ASADA of Tierra Blanca de Nicoya, which is why the provision of the service has not been suspended; on the contrary, it has been continuous and uninterrupted. With respect to the legal situation, once the pipe is installed and the interconnection with the Polvazales system is achieved, AyA will directly assume operation of the water supply system in order to legalize the provision of service. The respondent authority has budgeted the interconnection for January 30, 2022, so as to be able to analyze the appellants' request.

That being said, before resolving the contempt proceeding (gestión de desobediencia), it is fitting to highlight the considerations set forth by the Constitutional Chamber in Ruling No. 2020-10200 of 09:10 hours on June 5, 2020:

"First, the petitioning party comes before this Tribunal in order to have it order the 'AyA regional office of Nicoya to issue a water availability letter (carta de disponibilidad de agua), or alternatively, to allow the ASADA of Tierra Blanca to issue it, which must be accepted by the Municipality of Nicoya as part of the requirements for the construction of our home.' This Tribunal has held as established that the petitioner owns a plot of land in Tierra Blanca, Nicoya, Nicoya, Guanacaste. It has further been treated as undisputed that the aforementioned plot is required for the construction of a dwelling. In pursuit of that aim, the petitioner has applied for various permits from the Municipality of Nicoya and has requested from ICAA a 'water availability letter' (see the petition filed on February 27, 2019, which was submitted as evidence by ICAA). In this regard, it is established that in the area of Tierra Blanca, Nicoya, Nicoya, Guanacaste, the existing water supply system is administered by the Tierra Blanca Water Committee (Comité de Agua de Tierra Blanca).

However, it has been held as established that the Tierra Blanca Water Committee is not constituted as an ASADA, nor does it possess legal personality (personalidad jurídica) or a delegation agreement (convenio de delegación) signed with ICAA, and is therefore not authorized to extend or grant water supply services, nor to issue service availability certificates (Constancias de disponibilidad de servicio) or water capacity certificates (Constancias de Capacidad Hídrica). In response to the petitioner's request, on May 15, 2019, ICAA conducted a site visit to the Tierra Blanca, Nicoya, Guanacaste water supply system in order to assess its conditions. From the documentary evidence, it is established that on December 20, 2019, ICAA issued Official Letter No. GSD-UEN-GAR-2019-05351, which showed that: 1. The Tierra Blanca de Nicoya Water Committee currently provides 60 service connections and is not constituted as an ASADA, and therefore does not hold a delegation service agreement approved by ICAA to provide the service. 2.

It is supplied by a well that is not registered with the Water Directorate (Dirección de Aguas) and whose output is unknown. 3. The water supply system has a concrete storage tank with an approximate capacity of 48 m³. 4. At the time of the visit, it was observed that disinfection of the system is carried out by means of a drip system installed in the storage tank; however, no operational control is performed to regulate residual chlorine levels. 5. The Water Committee does not conduct potable water quality analyses. 6. The existing pipes do not have adequate diameters to provide an optimal service. For the foregoing reasons, it was concluded that the water supply system is not duly legalized to provide service. It is supplied by an illegal well. The storage tank requires improvements and maintenance. No operational control is performed. No water quality analyses are carried out to guarantee the potability (potabilidad) of the water.

The water supply network does not meet minimum pipe diameters and its useful life has already expired. In light of this, two recommendations were made: integration of the water supply system with a nearby, duly legalized ASADA capable of strengthening the Tierra Blanca Committee, or that the water supply system be assumed by ICAA, which operates a nearby system. On the other hand, on April 21, 2020, by means of Official Letter No. GSD-UEN-GAR-2020-01557 issued by the UEN for Rural Aqueduct Management of ICAA, a 'Declaration of Deficit Zone (Zona deficitaria), Tierra Blanca, Nicoya, Guanacaste' was issued, and it was agreed that: '1. The water supply system does not have a registered source with an assigned flow rate before the Water Directorate of MINAE for human consumption. 2. The water supply system does not have analyses to determine the potability of the water. Taking the foregoing into account, the water supply system does not have the technical and legal feasibility for the granting of service.

It is recommended NOT to issue service availability certificates or water capacity certificates while the Deficit Zone status remains in effect.' With this clarified, it follows that the issuance of a water availability letter is technically inadmissible since, first and foremost, the Water Committee cannot issue one because ICAA — as the regulatory authority (ente rector) in the matter — indicated that it is not a legally constituted ASADA and that the minimum requirements for such status are not met (note that there are irregularities with the well, water quality monitoring, and the existing pipes do not have adequate diameters to provide an optimal service, etc.). For those reasons, ICAA also cannot issue the aforementioned water availability letter. However, this Tribunal finds that what does infringe upon the petitioner's fundamental rights is ICAA's inadequate oversight of the water supply system in Tierra Blanca, Nicoya, Guanacaste.

It should be noted that, for the case under study, ICAA's responsibility in attending to the water supply system has not been disputed, since it is the entity that would be obligated to issue the water availability letter, and various inspections and recommendations have been made. That being so, the petitioning party — who owns a plot of land intended, in principle, for the construction of a home — has been affected by the omission of ICAA, as regulatory authority, to provide a definitive solution to the water supply system in Tierra Blanca, Nicoya, Guanacaste, particularly given the indication that it operates contrary to applicable regulations. Furthermore, it is noted that in December 2019, ICAA issued a series of recommendations, such as integration of the water supply system with a nearby, duly legalized ASADA capable of strengthening the Tierra Blanca Committee, or that the water supply system be assumed by ICAA, which operates a nearby system, without there being any established evidence that efficient measures were taken to resolve the problem facing the water supply system, which in turn impacts the petitioner's fundamental rights. Consequently, the constitutional appeal (recurso) is declared partially granted, in the terms to be set forth in the operative part (parte dispositiva) of this ruling" (emphasis not in the original).

In view of this, the order issued by this Chamber was "that within a period of THREE MONTHS, counted from the notification of this ruling, they shall proceed to provide a solution to the water supply system located in Tierra Blanca, Nicoya, Nicoya, Guanacaste, so that the provision of the service may be legally regularized. The necessary measures shall be taken to ensure that services are not suspended for the communities currently receiving them. Likewise, once the legal status of the water supply system is determined, the Regulatory Authority shall evaluate the petition submitted by the petitioner within the legally established timeframe." In other words, it is clear that this Tribunal observed that the provision of the service by a "Water Committee" rather than an ASADA was deficient not only because of the Committee's own legal status, but also because there were irregularities in the provision of the water service (improvements needed to the storage tank, pipes not having adequate diameters, among others). Furthermore, this Constitutional Tribunal, in Ruling No. 2020-17650 of 09:20 hours on September 18, 2020, extended the compliance period by eight months.

Now, it must be noted that in order to partially grant the deadline extension motion (gestión de ampliación de plazo) at that time, ICAA had indicated that:

"Regarding the Polvazales system: it is a system administered by AyA that has the hydrological conditions (condiciones hídricas) needed to absorb the consumption of users of the Tierra Blanca system. That being the case, for this to be technically viable, it is necessary to carry out improvements and expansions to the Polvazales network; through these, the hydraulic conditions (condiciones hidráulicas) required to guarantee the flows (caudales) demanded by future users of the Tierra Blanca community would be achieved, thereby meeting the requirements of quantity, quality, and continuity in the new integrated system" (emphasis not in the original).

That is to say, as ICAA has indicated in other writ of amparo (amparo) proceedings, for that institute to take over an aqueduct (acueducto), not only must legal requirements be met, but technical ones as well. Likewise, the Chamber has also indicated that ICAA — in the event it delegates the provision of the water service (servicio hídrico) — is obligated to ensure that the water service is adequately provided, since it is the governing body (ente rector). It should be noted that this Constitutional Tribunal did not indicate how this Chamber was to fulfill its mandate in order to provide a definitive solution to the matter of the aqueduct in question, since at the time the respondent Institute had stated that there were two viable options: "the integration of the aqueduct with a nearby duly legalized ASADA capable of strengthening the Tierra Blanca Committee, or that the aqueduct be assumed by ICAA, which has a nearby system." From the report submitted by the Executive President of ICAA, it was recorded that the intention is to carry out an interconnection (interconexión) with the "Polvazales" system and that the Institute will directly take over the operation of the aqueduct "in order to legalize the provision of the service." Thus, in the sub lite, there is no record that a definitive solution to the aqueduct providing potable water service has been realized and, as a logical consequence, that the admissibility of the request for water resource availability (disponibilidad del recurso hídrico) could have been analyzed.

Accordingly, what is appropriate is to reiterate compliance with what was ordered by this Chamber in judgments No. 2020-10200 of 09:10 hours on June 5, 2020, and No. 2020-17650 of 09:20 hours on September 18, 2020, with the understanding that all necessary measures must continue to be taken in order to legalize the provision of the service before January 30, 2022, as indicated to this Chamber, and so that the request for water resource availability managed by the interested party may subsequently be analyzed.

Por tanto:

Manuel Antonio Salas Pereira, in his capacity as General Manager, and Cecilia Martínez Artavia, in her capacity as Deputy Manager for Community Systems Management, both of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds those positions, are hereby reminded of their obligation, and Tomás Francisco Martínez Balladares, in his capacity as Executive President of the respondent Institute, or whoever holds that position, is hereby ordered, to comply with judgments No. 2020-10200 of 09:10 hours on June 5, 2020, and No. 2020-17650 of 09:20 hours on September 18, 2020, in accordance with the considerations stated in the sole recital (considerando único) of this ruling. Notify.

*200073760007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del ocho de octubre de dos mil veintiuno .

Gestión de desobediencia en el recurso de amparo que se tramita en expediente número 20-007376-0007-CO, interpuesto por [Nombre01 001], cédula de identidad [CED01] y [Nombre01 002] , cédula de identidad [CED02], contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA) Y LA ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE TIERRA BLANCA.

Resultando:

Por sentencia No. 2020-10200 de las 09:10 horas del 05 de junio de 2020, esta Sala declaró parcialmente con lugar el recurso de amparo, únicamente contra el ICAA, en los siguientes términos:

“Se declara con lugar el recurso, únicamente, contra el Instituto Costarricense de Acueductos y Alcantarillados. Se ordena a Manuel Antonio Salas Pereira, en su condición de Gerente General, y Cecilia Martínez Artavia, en su condición de Subgerente de Gestión de Sistemas Comunales, ambos del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen esos cargos, tomar las actuaciones que estén dentro del ámbito de sus competencias, para que dentro del plazo de TRES MESES, contado a partir de la notificación de esta sentencia, procedan a brindar una solución al acueducto ubicado en Tierra Blanca, Nicoya, Nicoya, Guanacaste, con el fin de que se regularice legalmente la prestación del servicio. Deberán tomar las medidas necesarias para asegurar que no se suspendan los servicios a las comunidades que actualmente los reciben. Asimismo, una vez definida la situación jurídica del acueducto, el Ente Rector deberá, valorar la gestión presentada por la recurrente en el plazo de ley.

Se advierte que de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, que se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados, al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia, atinente a la primera, de lo civil, y, relativo a la segunda, de lo contencioso administrativo. Notifíquese”.

El 09 de junio de 2020, el ICAA fue notificado de la sentencia No. 2020-10200 de las 09:10 horas del 05 de junio de 2020.

Mediante sentencia No. 2020-17650 de las 09:20 horas del 18 de septiembre de 2020, este Tribunal Constitucional resolvió lo siguiente: “Se corrige de oficio el error material que contiene la parte dispositiva de la resolución 2020-10200 de las 09:10 horas del 05 de junio de 2020, con el fin de que se entienda que la condenatoria de este recurso de amparo recae únicamente contra el Instituto Costarricense de Acueductos Alcantarillados, y que una eventual ejecutoria, deberá dirimirse ante la jurisdicción contenciosa administrativa. Respecto de la solicitud de ampliación de plazo, se le concede a Manuel Antonio Salas Pereira, en su condición de Gerente General, y Cecilia Martínez Artavia, en su condición de Subgerente de Gestión de Sistemas Comunales, ambos del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen esos cargos, un plazo de OCHO MESES, contado a partir de la solicitud (10 de setiembre de 2020), con el fin de que den cumplimiento definitivo a lo ordenado por esta Sala en la sentencia No. 2020-10200 de las 09:10 horas del 05 de junio de 2020. Notifíquese”.

Por escrito recibido el 20 de septiembre de 2021, la parte recurrente presentó una gestión de desobediencia a lo ordenado por esta Sala Constitucional en las sentencias No. 2020-10200 de las 09:10 horas del 05 de junio de 2020 y No. 2020-17650 de las 09:20 horas del 18 de septiembre de 2020.

Mediante resolución de las 16:59 horas del 22 de septiembre de 2021, la Magistrada Salas Torres le confirió audiencia a Manuel Antonio Salas Pereira, en su condición de Gerente General, y Cecilia Martínez Artavia, en su condición de Subgerente de Gestión de Sistemas Comunales, ambos del ICAA, o a quienes ocupen esos cargos, para que se refieran y aporten las pruebas correspondientes respecto a los hechos y omisiones que se les atribuyen.

Informa bajo juramento Tomás Francisco Martínez Balladares, en su condición de Presidente Ejecutivo del ICAA, en los siguientes términos:

“Mediante memorando N° GSP-RCHO-2021-03138 de fecha 28 de setiembre del 2021 (ver prueba N° 1), el Área de Ingeniería de la Dirección Regional Chorotega refiere sobre los avances y gestiones en acueducto Tierra Blanca de Nicoya, Guanacaste e indica: Avances. Entre las principales acciones y recursos utilizados, se recalca el avance con el Proyecto de sustitución de tuberías por diámetros mayores en el acueducto de Polvazales, para resolver y mejorar la capacidad hidráulica y las condiciones operativas del acueducto, con el fin de poder abastecer y conectar el acueducto de Tierra Blanca, El proyecto cuenta con un avance de un 100% en los diseños, especificaciones técnicas, términos de referencia, factibilidad ambiental y aprobación de presupuesto; el mismo consiste en la construcción de 800 ml de tubería de PVC SDR26 en 100 mm de diámetro, incluyendo la construcción de 10 previstas domiciliares, interconexión, válvulas y traslado de nuevas prevista domiciliar al hidrómetro existente.

También la construcción de 3 interconexiones de la tubería nueva con la tubería existente y 3 desconexiones de tuberías existente por sustituir. El presupuesto del proyecto es de 18 millones de colones. Actualmente se encuentra en proceso, la inscripción y publicación en SICOP del proyecto señalado, el cual se espera ser adjudicado y ejecuta en el transcurso de los próximos meses. Sumado a lo anterior también se está trabajando en la adquisición de los materiales y equipo requerido para la construcción de 400 ml de tubería entre los acueductos de Polvazales y Tierra Blanca, con recursos propios de AYA. También se encuentra en proceso el permiso y estudio del pozo que actualmente abastece el sistema de Polvazales para su pronta operación por parte de AYA, incluyendo la desinfección y monitoreo de la calidad del agua”. De lo anterior se desprenden los avances del proyecto para la sustitución de las tuberías y con esto mejorar la capacidad hidráulica y las condiciones operativas del acueducto de Polvazales y conectar el sistema de Tierra Blanca de Nicoya.

Además, el memorando supra citado refiere: Hitos relevantes Bajo el código BPIP 002992 se logró incorporar y matricular ante planificación el proyecto de la compra de tuberías necesarias para la conexión del Acueducto de Tierra Blanca con el Acueducto de Polvazales, sin embargo, no se logró contar con los recursos económicos debido a temas de recorte presupuestario ajenos a la gestión operativa, pues las asignaciones presupuestarias no depende de esta región, como área operativa. Lo señalado en el párrafo anterior, afecto los plazos establecidos, para lograr incorporar más agua al sistema de Tierra Blanca de Nicoya para luego considerar la aprobación de nuevos servicios al sistema afectado; más, sin embargo, tal y como se describió en los párrafos anteriores se continuó realizando esfuerzos para lograr la meta propuesta, sacrificando otros proyectos importantes para los sistemas operados por AyA en la Región Chorotega.

Es importante acotar, que actualmente la ASADA Tierra Blanca, esta brindado un servicio continuo y sin afectaciones a los actuales usuarios (con el acompañamiento operativo de AyA), más sin embargo, debido a las condiciones de oferta hídrica no les es posible aumentar nuevos servicios hasta el tanto no se cuente con las mejoras descritas en el presente informe. En el presente caso, las personas usuarias actuales del sistema operado por la ASADA de Tierra Blanca de Nicoya cuentan con un servicio continuo y sin afectaciones y con el acompañamiento operativo del AyA y se está a la espera de la interconexión con el sistema de Polvazales, para lo cual se requiere la instalación de la tubería, la cual ya se solicitó mediante el código BPIP 002992, lográndose incorporar y matricular ante planificación y se espera que para al 30 de enero del 2022 la situación esté resuelta y se puedan emitir nuevas constancias de disponibilidad de servicio.

El voto N° 2020-010200 de las nueve horas diez minutos del cinco de junio de dos mil veinte lo que ordena al AyA: 1. Regularizar legalmente la prestación del servicio que brinda la ASADA de Tierra Blanca de Nicoya. 2. Asegurar que no se suspendan los servicios a las comunidades que actualmente los reciban. 3. Una vez definida la situación jurídica del acueducto, valorar la gestión presentada por los recurrentes. Tal como se indicó con anterioridad, el AyA está brindando acompañamiento operativo a la ASADA de Tierra Blanca de Nicoya, razón por la cual, la prestación del servicio no se ha visto suspendida, sino que, por el contrario, el mismo es continuo y sin afectaciones. En lo que respecta a la situación legal, una vez instalada la tubería y lograda la interconexión con el sistema de Polvazales, el AyA asumirá de manera directa la operación del acueducto, con el fin de legalizar la prestación del servicio.

Finalmente, se espera para el 30 de enero del 2022 tener realizada esta interconexión y así, poder analizar la solicitud de los recurrentes, lo cual no depende de la situación jurídica de la ASADA Tierra Blanca de Nicoya, sino, verificando de previo que exista capacidad hídrica, pues se reitera, que existen situaciones de faltante de recurso hídrico que devienen en fuerza mayor y que son ajenas al AyA”.

Por constancia del 05 de octubre de 2021, la Secretaría de la Sala Constitucional hizo constar que “no apareció que del 23 de septiembre al 04 de octubre de 2021, el gerente general y la subgerente de Gestión de Sistemas Comunales, ambos del Instituto Costarricense de Acueductos y Alcantarillados, hayan presentado escrito o documento alguno, a fin de rendir el informe que se les solicitó en la resolución dictada a las dieciséis horas cincuenta y nueve minutos del veintidós de setiembre de dos mil veintiuno, en el expediente número 20-007376-0007-CO que es RECURSO DE AMPARO promovido por [Nombre01 001], [Nombre01 002]”.

En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Garro Vargas; y,

Considerando:

ÚNICO. SOBRE LA DESOBEDIENCIA ALEGADA. Por escrito recibido el 20 de septiembre de 2021, la recurrente [Nombre01 002] presentó una gestión de desobediencia a lo ordenado por esta Sala Constitucional a las sentencias No. 2020-10200 de las 09:10 horas del 05 de junio de 2020 y No. 2020-17650 de las 09:20 horas del 18 de septiembre de 2020. En el escrito, la parte recurrente manifestó que el plazo de ocho meses adicionales conferido en la sentencia No. 2020-17650 ya estaba vencido y el ICAA no ha dado una solución para poder construir las casas de habitación.

Ahora bien, en el informe rendido por la Presidencia Ejecutiva del ICAA, se señaló que mediante memorando N° GSP-RCHO-2021-03138 de fecha 28 de setiembre del 2021, el Área de Ingeniería de la Dirección Regional Chorotega se refirió sobre los avances y gestiones en acueducto Tierra Blanca de Nicoya, Guanacaste y se consignó:

“Avances .Entre las principales acciones y recursos utilizados, se recalca el avance con el Proyecto de sustitución de tuberías por diámetros mayores en el acueducto de Polvazales, para resolver y mejorar la capacidad hidráulica y las condiciones operativas del acueducto, con el fin de poder abastecer y conectar el acueducto de Tierra Blanca, El proyecto cuenta con un avance de un 100% en los diseños, especificaciones técnicas, términos de referencia, factibilidad ambiental y aprobación de presupuesto; el mismo consiste en la construcción de 800 ml de tubería de PVC SDR26 en 100 mm de diámetro, incluyendo la construcción de 10 previstas domiciliares, interconexión, válvulas y traslado de nuevas prevista domiciliar al hidrómetro existente. También la construcción de 3 interconexiones de la tubería nueva con la tubería existente y 3 desconexiones de tuberías existente por sustituir. El presupuesto del proyecto es de 18 millones de colones.

Actualmente se encuentra en proceso, la inscripción y publicación en SICOP del proyecto señalado, el cual se espera ser adjudicado y ejecuta en el transcurso de los próximos meses. Sumado a lo anterior también se está trabajando en la adquisición de los materiales y equipo requerido para la construcción de 400 ml de tubería entre los acueductos de Polvazales y Tierra Blanca, con recursos propios de AYA. También se encuentra en proceso el permiso y estudio del pozo que actualmente abastece el sistema de Polvazales para su pronta operación por parte de AYA, incluyendo la desinfección y monitoreo de la calidad del agua” (el resaltado no es del original).

De igual manera, en el memorando aportada como prueba por el ICAA se consignaron los avances del proyecto para la sustitución de las tuberías y con esto mejorar la capacidad hidráulica y las condiciones operativas del acueducto de Polvazales y conectar el sistema de Tierra Blanca de Nicoya. En dicho oficio se consignó lo siguiente:

“Bajo el código BPIP 002992 se logró incorporar y matricular ante planificación el proyecto de la compra de tuberías necesarias para la conexión del Acueducto de Tierra Blanca con el Acueducto de Polvazales, sin embargo, no se logró contar con los recursos económicos debido a temas de recorte presupuestario ajenos a la gestión operativa, pues las asignaciones presupuestarias no depende de esta región, como área operativa. Lo señalado en el párrafo anterior, afecto los plazos establecidos, para lograr incorporar más agua al sistema de Tierra Blanca de Nicoya para luego considerar la aprobación de nuevos servicios al sistema afectado; más, sin embargo, tal y como se describió en los párrafos anteriores se continuó realizando esfuerzos para lograr la meta propuesta, sacrificando otros proyectos importantes para los sistemas operados por AyA en la Región Chorotega” (el resaltado no es del original).

Por último, el representante del ICAA indicó que lo que ordenó la Sala buscaba: “regularizar legalmente la prestación del servicio que brinda la ASADA de Tierra Blanca de Nicoya. 2. Asegurar que no se suspendan los servicios a las comunidades que actualmente los reciban. 3. Una vez definida la situación jurídica del acueducto, valorar la gestión presentada por los recurrentes”. También se indicó que el ICAA está brindando acompañamiento operativo a la ASADA de Tierra Blanca de Nicoya, razón por la cual, la prestación del servicio no se ha visto suspendida, sino que, por el contrario, el mismo es continuo y sin afectaciones. En lo que respecta a la situación legal, una vez instalada la tubería y lograda la interconexión con el sistema de Polvazales, el AyA asumirá de manera directa la operación del acueducto, con el fin de legalizar la prestación del servicio. La autoridad recurrida tiene presupuestada la interconexión para el 30 de enero de 2022, para así poder analizar la solicitud de los recurrentes.

Así las cosas, de previo a resolver la gestión de desobediencia, conviene resaltar las consideraciones dadas por la Sala Constitucional en la sentencia No. 2020-10200 de las 09:10 horas del 05 de junio de 2020:

“Primeramente, la parte recurrente acude ante este Tribunal con el fin de que se ordene al ´AyA oficina regional de Nicoya, extender la carta de disponibilidad de agua, o bien, permitir que la extienda la ASADA de Tierra Blanca, misma que deberá ser admitida por la Municipalidad de Nicoya como parte de los requisitos para construcción de nuestra casa´. Ahora bien, este Tribunal ha tenido por acreditado que la recurrente tiene un terreno en Tierra Blanca, Nicoya, Nicoya, Guanacaste. Además, se ha tenido como no controvertido que el citado terreno se requiere para la construcción de una vivienda. Ante esa pretensión, la recurrente ha requerido diversos permisos ante la Municipalidad Nicoya y, ante el ICAA una ´carta de disponibilidad de agua´ (véase la gestión incoada el 27 de febrero de 2019, que fue aportada como prueba por el ICAA). En ese orden de ideas, se constata que en la zona de Tierra Blanca, Nicoya, Nicoya, Guanacaste, el acueducto existente es administrado por el Comité de Agua de Tierra Blanca.

Sin embargo, se ha tenido por acreditado que el Comité de Agua de Tierra Blanca no está constituido como ASADA, ni posee personalidad jurídica o convenio de delegación firmado con el ICAA, por lo que no está facultado para extender u otorgar servicios de acueducto, ni emitir constancias de disponibilidad de servicios o capacidad hídrica. Ante la solicitud de la recurrente, el 15 de mayo de 2019, el ICAA realizó una visita al acueducto de Tierra Blanca, Nicoya, Guanacaste, con el fin de determinar las condiciones del citado acueducto. De la prueba documental, se extrae que el 20 de diciembre de 2019, el ICAA emitió el oficio No. GSD-UEN-GAR-2019-05351 en el que se demostró que: 1. El Comité de Agua de Tierra Blanca de Nicoya, actualmente brinda 60 servicios y no se encuentra constituido como ASADA y por ende no cuenta con servicio de delegación aprobado por el ICAA para brindar el servicio. 2.

Se abastece por medio de un pozo que no se encuentra inscrito ante Dirección de Aguas y del cual se desconoce su producción. 3. El acueducto cuenta con un tanque de almacenamiento de concreto con una capacidad aproximada de 48m3. 4. En el momento de la visita, se observó que se realiza desinfección en el sistema mediante un sistema por goteo instalado en el tanque de almacenamiento sin embargo no se realiza control operativo para regular el cloro residual. 5. El Comité de Agua no cuenta con análisis de calidad de agua potable. 6. Las tuberías existentes no cuentan con diámetro adecuados para brindar un servicio óptimo. Por lo anterior, se concluyó que el acueducto no está debidamente legalizado para brindar el servicio. Se abastecen por medio de un pozo ilegal. El tanque de almacenamiento requiere mejoras y mantenimiento. No se realiza control operativo. No se realizan análisis de calidad de agua que garanticen la potabilidad de la misma.

La red de acueducto no cumple con los diámetros mínimos y ya se venció su vida útil. Ante ello, se hicieron dos observaciones: la integración del acueducto con una ASADA cercana debidamente legalizada y capaz de fortalecer el Comité de Tierra Blanca o que el acueducto sea asumido por el ICAA que cuenta con un sistema cercano. Por otro lado, el 21 de abril de 2020, mediante oficio No. GSD-UEN-GAR-2020-01557 emitido por la UEN de Gestión de Acueductos Rurales del ICAA se emitió una ´Declaratoria de Zona deficitaria, Tierra Blanca, Nicoya, Guanacaste´ y se acordó que: ´1. El acueducto no cuenta con una fuente inscrita y con caudal asignado ante Dirección de Aguas del MINAE, para consumo humano. 2. El acueducto no cuenta con análisis que determinen la potabilidad del agua. Tomando en cuenta lo anterior el acueducto no cuenta con factibilidad técnica y legal para el otorgamiento del servicio.

Se recomienda NO brindar Constancias de disponibilidad de servicio o Constancias de Capacidad Hídrica, mientras se mantenga el estado de Zona Deficitaria´. Aclarado esto, se desprende que resulta técnicamente improcedente la emisión de una carta de disponibilidad, ya que, en primer lugar, el Comité de Agua no la puede expedir puesto que el ICAA -como ente rector en la materia- señaló que no son una ASADA legalmente constituida y, que tampoco se cumple con los requisitos mínimos para ello (véase que hay irregularidades con el pozo, la medición de la calidad del agua, las tuberías existentes no cuentan con diámetro adecuados para brindar un servicio óptimo, etc.). Ante esos motivos, el ICAA tampoco puede expedir la citada carta de disponibilidad. Sin embargo, estima este Tribunal que lo que sí infringe los derechos fundamentales de la recurrente, es la indebida vigilancia por parte del ICAA, en relación con el acueducto en Tierra Blanca, Nicoya, Guanacaste.

Adviértase que, en para el caso en estudio, ha resultado como no controvertida la responsabilidad del ICAA en la atención del acueducto, ya que, es quien estaría en la obligación de expedir la carta de disponibilidad hídrica; y, se han realizado diversas inspecciones y recomendaciones a seguir. Así las cosas, la parte recurrente -quien tiene un lote y, en principio es para construir su vivienda-, se ha visto afectado por la omisión del ICAA -como ente rector- de brindar una solución definitiva al acueducto en Tierra Blanca, Nicoya, Guanacaste, máxime cuando se indicó que el mismo se opera de forma contraria a la normativa. Incluso, se aprecia que en el mes de diciembre de 2019, el ICAA emitió una serie de recomendaciones como la integración del acueducto con una ASADA cercana debidamente legalizada y capaz de fortalecer el Comité de Tierra Blanca o que el acueducto sea asumido por el ICAA que cuenta con un sistema cercano, sin que se tenga por acreditado que se hayan tomado medidas eficientes para solventar la problemática que vive el acueducto y que, repercute en los derechos fundamentales de la recurrente. En consecuencia, se declara parcialmente con lugar el recurso, en los términos que se dirán en la parte dispositiva de esta resolución (el resaltado no es del original).

Visto esto, véase que la orden dada por esta Sala fue “que dentro del plazo de TRES MESES, contado a partir de la notificación de esta sentencia, procedan a brindar una solución al acueducto ubicado en Tierra Blanca, Nicoya, Nicoya, Guanacaste, con el fin de que se regularice legalmente la prestación del servicio. Deberán tomar las medidas necesarias para asegurar que no se suspendan los servicios a las comunidades que actualmente los reciben. Asimismo, una vez definida la situación jurídica del acueducto, el Ente Rector deberá, valorar la gestión presentada por la recurrente en el plazo de ley.”. Es decir, se aprecia que este Tribunal observó que la prestación del servicio que daba un “Comité de Agua” y no una ASADA era deficitario no solo por el hecho de la situación legal del Comité propiamente, sino que también existían irregularidades en la prestación del servicio de agua (mejoras en el tanque de almacenamiento, las tuberías no tienen un diámetro, entre otros). Por otro lado, este Tribunal Constitucional en la sentencia No. 2020-17650 de las 09:20 horas del 18 de septiembre de 2020, amplió el plazo de cumplimiento por ocho meses.

Ahora bien, impone advertir que para acoger parcialmente la gestión de ampliación de plazo, en esa oportunidad, el ICAA había indicado que:

“En cuanto al sistema de Polvazales es un sistema administrado por AyA que cuenta con las condiciones hídricas, para asumir el consumo de los usuarios del sistema Tierra Blanca. Así las cosas; para que esto sea técnicamente viable, es necesario realizar mejoras y ampliaciones en la red de polvazales, con ellas se lograría materializar as condiciones hidráulicas necesarias para garantizar los caudales demandados por los futuros usuarios de la comunidad de Tierra Blanca, cumpliendo de esta manera con la cantidad, calidad y continuidad en el nuevo sistema integrado” (el resaltado no es del original).

Es decir, tal y como lo ha señalado el ICAA en otros procesos de amparo, para que dicho instituto asuma un acueducto no solo se deben cumplir requisitos legales, sino también técnicos. Asimismo, la Sala también ha señalado que el ICAA -en caso de delegar la prestación del servicio hídrico- está en la obligación de velar por el cumplimiento de una adecuada prestación del servicio de agua, ya que es el ente rector. Nótese que este Tribunal Constitucional no indicó como debía cumplirse esta Sala para brindar una solución definitiva al tema del acueducto en cuestión, pues en su oportunidad el Instituto recurrido había manifestado que habían dos opciones viables: “la integración del acueducto con una ASADA cercana debidamente legalizada y capaz de fortalecer el Comité de Tierra Blanca o que el acueducto sea asumido por el ICAA que cuenta con un sistema cercano”.

Del informe rendido por el Presidente Ejecutivo del ICAA se consignó que se pretende hacer una interconexión con el sistema de “Polvazales” y que el Instituto asumirá de manera directa la operación del acueducto a “fin de legalizar la prestación del servicio”. Así, para el sub lite, no consta que se haya materializado una solución definitiva al acueducto que brinda el servicio en agua potable y, como consecuencia lógica, que se haya podido analizar la procedencia de la solicitud de disponibilidad del recurso hídrico.

En consecuencia, lo que procede es reiterar el cumplimiento a lo ordenado por esta Sala en las sentencias No. 2020-10200 de las 09:10 horas del 05 de junio de 2020 y No. 2020-17650 de las 09:20 horas del 18 de septiembre de 2020, bajo el entendido que se deberán continuar tomando todas las medidas necesarias, a fin de legalizar la prestación del servicio antes del 30 de enero de 2022, tal como se indicó a esta Sala y para que posteriormente se analice la solicitud de disponibilidad del recurso hídrico gestionado por la parte interesada.

Por tanto:

Se le reitera a Manuel Antonio Salas Pereira, en su condición de Gerente General, y Cecilia Martínez Artavia, en su condición de Subgerente de Gestión de Sistemas Comunales, ambos del Instituto Costarricense de Acueductos y Alcantarillados, o a quienes ocupen esos cargos, y se le ordena a Tomás Francisco Martínez Balladares, en su condición de Presidente Ejecutivo del Instituto recurrido, o a quien ejerza el cargo, el cumplimiento de las sentencias No. 2020-10200 de las 09:10 horas del 05 de junio de 2020 y No. 2020-17650 de las 09:20 horas del 18 de septiembre de 2020, bajo las consideraciones indicadas en el considerando único de esta resolución. Notifíquese.
