Writ of amparo (recurso de amparo) filed under case number 21-014620-0007-CO, brought by Nombre01, national ID number CED01, against the MUNICIPALIDAD DE SIQUIRRES.

Background:

  1. 1By written submission received by the Court on July 29, 2021, the petitioner filed a writ of amparo. She states that she has lived in the community of Siquirres, Dirección01, for 40 years. She indicates that the excessive and uncontrolled development by the local government has caused disorder and traffic chaos that infringes upon the fundamental rights of the residents of that community. She adds that economic and commercial growth without appropriate measures has caused noise pollution (contaminación sónica) and environmental pollution. She states that by means of a written communication dated December 3, 2019, she informed the mayor that the pollution caused by trucks parking in front of her home affects her health. However, she alleges that she received no response whatsoever. Likewise, by written communication dated April 16, 2020, she presented the issue to the Municipal Council (Concejo), which, during ordinary session No. 208 held on April 20, 2020, referred it to the Legal Affairs Department.Subsequently, through opinion No. 154-2020, that department decided to change the road markings (demarcación) on the street. To this end, the chief of the Siquirres Traffic Delegation conducted several inspections and recommended, in point 5: establishing a loading and unloading (carga y descarga) area that meets the conditions to prevent trucks from obstructing traffic, and in point 6: relieving congestion in the reported area for the sake of public health. She argues that, through written order DA-915-2020 dated November 18, 2020, the respondent mayor ordered the area where trucks park in front of her home to be marked with a yellow line (línea amarilla), without weighing the public interest. She considers that, given the excessive growth of commercial establishments, the municipal administration must reserve a space for the loading and unloading of goods in order to prevent traffic chaos, disorder, and the noise and environmental pollution that harms all residents of that community. She insists that on repeated occasions, sidewalks (aceras) are blocked with merchandise due to the traffic congestion caused by trucks that obstruct the passage of vehicles, buses, and ambulances.
  2. 2By resolution issued at 17:23 hours on August 4, 2021, the amparo proceeding was admitted.
  3. 3Mangell Mc Lean Villalobos, Randall Blake Reid, and William Solano Ocampo — serving respectively as mayor, president of the Municipal Council, and director of the Departamento de Infraestructura Vial Cantonal — all of the Municipalidad de Siquirres, submit sworn statements. They refer to the applicable legislation. They affirm that municipalities have the authority to exercise road signage and marking (señalización vial) within the territories under their jurisdiction and administration. They state that at extraordinary session No. 1 of July 24, 2018, authorization was granted to initiate the process of conducting a traffic impact study (estudio de impacto vial) in order to implement new road markings in the center of Siquirres. They recount that on June 4, 2020, the Junta Vial Cantonal reviewed the petitioner's written communication, forwarded by the Municipal Council, in which she requested that the loading and unloading zone for the Fábrica de Hielo be relocated or designated, because it generates noise that affects her health.At that session of the Junta Vial Cantonal, it was reported that the protected party's (amparada's) request was encompassed within the traffic impact study. On December 3, 2019, the mayor's office received a written communication from the petitioner requesting the aforementioned relocation. The site reportedly had no road markings of any kind. On December 2, 2019, the traffic police were notified, and a confrontation between the petitioner's husband and the owner of the Fábrica de Hielo was reported. Reference is made to the evidence in the record. On April 14, 2020, the Siquirres Traffic Delegation of the Dirección General de Policía de Tránsito of MOPT informed the petitioner that the loading and unloading zone had no road markings of any kind (yellow zone) and recommended that the zone be designated in order to regulate and resolve the problem. On April 16, 2021, the Municipal Council received a letter from the petitioner setting out the problem.It was referred to the Junta Vial Cantonal. On June 22, 2020, the Junta Vial Cantonal informed the mayor of the resolution issued at ordinary session No. 3, Article VIII of the session held on Thursday, June 4, 2020, in which the conduct of the traffic impact study was ordered. Subsequently, on August 31, 2020, the Departamento de Infraestructura Vial Cantonal set out the following findings in its inspection report: "…- That on the sidewalk of the property, yellow-line road markings are observed along the edge; - That across from the property, there is (sic) a mini-supermarket; - That on the sidewalk in front of the mini-supermarket, the yellow line has faded; - That upon arrival, vehicles were found parked in front of the property on both sides of the road; - That trucks were parked in front of the mini-supermarket and, throughout the duration of the inspection, did not turn off their engines…".On September 2, 2020, the protected party (amparada) submitted a written communication to the Junta Vial Cantonal requesting that the yellow line be repainted, as it had faded over time; it was referred, by means of resolution No. 202003009-04, to the Dirección del Gestor de Infraestructura Vial. Thus, on September 3, 2020, at session No. 6-2020, the Junta Vial Cantonal reviewed the protected party's (tutelada's) written communication and, through resolution No. 20200309-04, ordered that Engineer Solano Ocampo, Head of the Departamento de Infraestructura Vial Cantonal, be instructed to include in the municipal work crew's schedule the repainting of the yellow line that was no longer visible on the block in front of the Fábrica de Hielo. On October 5, 2020, the municipality received a written communication signed by Ricardo Méndez Salazar, legal representative of Prado del Caribe, as well as a communication from licensed business owners (patentados) Concentrados para animales Mundo de Mascotas Mi Mejor Amigo, Fotocopiadora CopyPrint, and Verdulería Los Campesinos — tenants of commercial premises owned by Prado del Caribe — in which they expressed their disagreement with the measures taken by the Departamento de Infraestructura Vial to mark with a yellow line the area in front of the commercial establishments.In addition, a written communication was received from the licensed business owners, merchants, and users of the area where the yellow line in question had been marked, in which they alleged that the road marking had been carried out without any authorization or technical study, and that this was harmful to the commercial community of the area. The foregoing was reviewed at ordinary session No. 023 held on October 6, 2020, at which the Municipal Council resolved to refer the written communication to the Mayor's Office for a final determination. In response, on October 15, 2020, at extraordinary session No. 03-2020, resolution No. 20200309-07 was issued, which definitively and unanimously ratified the instruction to the engineer of the Departamento de Infraestructura Vial Cantonal to carry out the road marking of the town center (casco central), in accordance with the study conducted by the Traffic Engineering Department, beginning the road markings at intersections and subsequently at lane transitions in the area of the central market.Likewise, through resolution No. 20201015-06, it was stated that "in order to stimulate local economic development and protect public and private interests, the Engineer of the Departamento de Infraestructura Vial Cantonal is instructed to correct the painted section in front of the Fábrica de Hielo, leaving only 10 meters marked on each side of the road. As appears in images 7 and 12 of the case file." On June 2, 2021, Engineer Solano Ocampo, Director-Manager of the Departamento de Infraestructura Vial Cantonal, requested, through official memorandum JVC-201-046, the drafting of a Loading and Unloading Regulation (Reglamento de Carga y Descarga) in order to be able to mark the zones within the canton's town center. As a result, through the resolution issued at ordinary session No. 05 of June 3, 2021, the Junta Vial Cantonal approved that request. They add the following: "It is not true that there exists excessive and uncontrolled development on the part of the Local Government.While it is true that the Municipality currently lacks a master zoning plan (Plan Regulador), the fact is that we are close to its approval and have already held the required Public Hearing. This does not mean that there is traffic chaos in our canton, or that the actions being carried out are not grounded in technical norms and criteria. As reflected in the background of this case, the Junta Vial Cantonal approved a technical traffic impact study, which was ratified on two separate occasions. (…) It is partially true that some noise pollution exists, which has not been measured against the technical parameters required by applicable regulations, and for which jurisdiction lies not with the municipality but with the Ministry of Health. (…) The written communications submitted by the petitioner have been addressed by the offices of the undersigned on various occasions; the most recent resolution of the Junta Vial Cantonal approved removing the road marking that had been placed along the edge of the sidewalk in front of the petitioner's home, given that the zone had been designated as a yellow zone — and marking both sides of the street in that manner creates an even greater problem, namely harming the entire commercial sector of the area.Accordingly, it has been proposed to install signs over the yellow zone indicating that it is a loading and unloading zone and that trucks are permitted there with their engines off for a maximum of 30 minutes, as well as to proceed with the drafting of the Regulation (Reglamento) to govern loading and unloading zones, which is currently in the process of being submitted to the Junta Vial Cantonal. (…) It is not true that the petitioner has not received a response to her requests. On a first occasion, the petitioner's request was granted and the zone in front of her residence was marked with road markings pursuant to instructions from the Junta Vial Cantonal. However, the neighboring licensed business owners filed complaints, as did other users, and consequently that decision was revoked and the option of signs was chosen instead; those signs are currently in the drafting-request phase, within the framework of the on-demand contracting arrangement that is already in the execution phase, which is attached as documentary evidence, while the regulation that will govern and put an end to this problem is being finalized.Those signs are permitting parking with the engine off, for the purpose of safeguarding the petitioner's right to health, given that she suffers from anxiety disorder. (…) It is not true that the Mayor's Office failed to weigh the cantonal public interest when assessing whether or not to mark the yellow zone. On the contrary, as reflected in the background of this response, such criteria were applied on the basis of the regulations and administrative case law governing the matter, and the technical traffic impact studies carried out by the municipality, which were approved and ratified by the Junta Vial Cantonal. (…) the draft loading and unloading regulation, which would govern the use of those spaces both for merchants and for product distributors, must be completed; as noted, it is in the final stages of drafting in the Legal Advisory Unit of the Departamento de Infraestructura Vial Cantonal (…) the municipal police and the traffic police, among other functions, monitor compliance with the requirement that sidewalks not be blocked with merchandise. However, the available personnel is limited and every effort is being made to provide the best possible service."
  4. 4The legal requirements governing the proceedings have been observed.

Opinion authored by Justice Rueda Leal; and,

Considering:

I.Object of the appeal. The appellant (recurrente) alleges that her fundamental rights have been violated, inasmuch as in 2019 she filed a complaint with the Municipalidad de Siquirres regarding noise pollution (contaminación sónica) and obstruction of the free flow of traffic (libre tránsito) caused by trucks that park in front of her home while performing loading and unloading operations at commercial establishments in her neighborhood. She claims that, to date, this problem continues.

II.Proven facts. For the purposes of deciding this matter, the following facts are deemed duly established, either because they have been substantiated or because the respondent failed to address them, as required by the initial order:

  • a)The appellant is a resident of Siquirres, Dirección01 (undisputed fact).
  • b)On December 3, 2019, the petitioner (amparada) filed a complaint with the Municipalidad de Siquirres, in which she stated the following: "…I am living through a rather serious situation involving the owner of the ice factory (…) he has two trucks for loading and unloading ice; when he carries out that work, he leaves the trucks running for up to two consecutive hours, which is causing me health problems. (…) I ask for your help in speaking with the Municipal Police so that they take control of the matter. (…) I have had to visit the doctor because of the health problem (…) this situation affects me physically and emotionally (sic), causing me an Anxiety Disorder (sic)…" (see evidence submitted to the digital case file).
  • c)On December 2, 2020, the petitioner filed a request with the Dirección General de la Policía de Tránsito, in which she asked for "an order of prohibition so that the loading and unloading trucks be moved to a place where they do not cause such high noise pollution (ruido) in front of my house, as it is causing me an Anxiety Disorder (sic)…" (see sworn report and evidence submitted to the digital case file).
  • d)On April 14, 2020, the Delegación de Tránsito de Siquirres responded to the request filed by the petitioner, detailing the actions taken to address the complaint; it also recommended "designating a loading and unloading space that meets the conditions and characteristics needed for trucks engaged in commercial activity there to carry out their maneuvers without obstructing the free flow of traffic; said space could be at Dirección02, which has low vehicular traffic and is approximately 75 meters from the establishments where said vehicles currently obstruct the roadway. This would greatly relieve congestion in the reported area, while aiming to protect the health of the complainant based on the medical opinion presented, which certifies the diagnosis of Anxiety Disorder. Additionally, it is noted that once the noise measurement equipment is enabled and calibrated, measurements will be taken of the freight vehicles that arrive at the site for loading or unloading of goods…" (see evidence submitted to the digital case file).
  • e)On April 16, 2020, the appellant requested that the Concejo Municipal de Siquirres designate a loading area that would meet the conditions and characteristics needed for trucks to maneuver without obstructing the free flow of traffic; she also requested the road marking (demarcación) of the zone (see sworn report and evidence submitted to the digital case file).
  • f)On May 1, 2020, the Comisión Permanente de Asuntos Jurídicos of the Municipalidad de Siquirres, through opinion No. 154-2020, agreed to refer the petitioner's request to the Junta Vial Cantonal of that municipality, so that the possibility of making the requested changes and road markings could be analyzed (see evidence submitted to the digital case file).
  • g)On May 21, 2020, the municipal mayor of Siquirres received opinion No. 154-2020, issued by the Comisión Permanente de Asuntos Jurídicos of that municipality (see evidence submitted to the digital case file).
  • h)On May 25, 2020, the mayor's office forwarded to the Junta Vial Cantonal the resolution adopted by the Comisión Permanente de Asuntos Jurídicos, pursuant to the request filed by the petitioner (see sworn report and evidence submitted to the digital case file).
  • i)On June 4, 2020, the Junta Vial Cantonal, at regular session No. 3, Article VIII, considered the petitioner's (tutelada's) request and agreed to order a traffic impact study (estudio de impacto vial) of the reported area (see sworn report).
  • j)On June 22, 2020, the Junta Vial Cantonal notified the municipal mayor of the resolution adopted on June 4, 2020 (see sworn report and evidence submitted to the digital case file).
  • k)By inspection report dated August 31, 2020, the Departamento de Infraestructura Vial Cantonal determined: "…-That on the sidewalk of the property, yellow-line road marking is observed at the curb; -That in front of the property there is a mini-market; -That on the sidewalk in front of the mini-market, the yellow line has been erased; -That upon arrival, vehicles were found parked in front of the property on both sides of the road; -That in front of the mini-market, trucks were found parked and, throughout the time spent conducting the inspection, they did not turn off their engines…" (see sworn report and evidence submitted to the digital case file).
  • l)On September 2, 2020, the petitioner submitted a letter to the Junta Vial Cantonal requesting the road marking of the yellow line (see sworn report and evidence submitted to the digital case file).
  • m)On September 3, 2020, through resolution No. 202003009-04, the Dirección del Gestor de Infraestructura Vial, pursuant to the letter submitted by the appellant, ordered "that engineer Solano Ocampo, Head of the Departamento de Infraestructura Vial Cantonal, be instructed to include within the municipal work crew's (cuadrilla municipal) schedule the repainting of the yellow line that was not visible on the block in front of the ice factory" (see sworn report and evidence submitted to the digital case file).
  • n)On September 10, 2020, the Departamento de Infraestructura Vial Cantonal received resolution No. 202003009-04, issued by the Dirección del Gestor de Infraestructura Vial (see evidence submitted to the digital case file).
  • o)On October 5, 2020, the respondent municipality received a note signed by Mr. Ricardo Méndez Salazar, legal representative of Prado del Caribe, as well as a note from the permit holders (patentados) "Concentrados para animales Mundo de Mascotas Mi Mejor Amigo," "Fotocopiadora CopyPrint," and "Verdulería Los Campesinos," expressing their disagreement with the measures taken by the Departamento de Infraestructura Vial Cantonal to mark with a yellow line in front of the commercial establishments (see sworn report and evidence submitted to the digital case file).
  • p)On October 6, 2020, the Concejo de Siquirres considered the letter submitted by the legal representative of Prado del Caribe, as well as the note from the permit holders "Concentrados para animales Mundo de Mascotas Mi Mejor Amigo," "Fotocopiadora CopyPrint," and "Verdulería Los Campesinos," and agreed to forward the same to the Mayor's Office for a definitive resolution (see sworn report and evidence submitted to the digital case file).
  • q)On October 15, 2020, at extraordinary session No. 03-2020, the respondent authority issued resolution No. 20200309-07, which unanimously and definitively ratified the instruction "to instruct the engineer of the Departamento de Infraestructura Vial Cantonal to carry out the road marking of the town center (casco central), in accordance with the study conducted by the Departamento de Ingeniería de Tránsito, beginning the road marking at intersections, followed by lane changes in the area of the central market" (see sworn report and evidence submitted to the digital case file).
  • r)On October 15, 2020, at extraordinary session No. 03-2020, the respondent authority issued resolution No. 20201015-06, stating that "in order to stimulate local economic development, and to protect the public and private interest, the engineer of the Departamento de Infraestructura Vial Cantonal is instructed to correct the stretch marked in front of the ice factory, leaving only 10 meters marked on each side of the road."   • s)On June 2, 2021, engineer Solano Ocampo, Director-Manager of the Departamento de Infraestructura Vial Cantonal, requested by means of official communication JVC-201-046 that the Junta Vial Cantonal draft a Reglamento de Carga y Descarga in order to be able to mark the zones within the canton's town center." (see sworn report and evidence submitted to the digital case file).
  • t)On June 3, 2021, the Junta Vial Cantonal approved the request of the Director-Manager of the Departamento de Infraestructura Vial Cantonal (see sworn report).
  • u)Currently, the respondent authority lacks a Regulatory Plan (Plan Regulador), which is close to being approved; likewise, completion of the Reglamento de Carga y Descarga project for the area is pending, as it is in its final stage at the Asesoría Legal of the Departamento de Infraestructura Vial Cantonal (see sworn report).
  • v)According to the sworn report, "while the regulation is being finalized—which will regulate and put an end to the solution of this problem—it has been proposed to place signs over the yellow zone indicating that it is a loading and unloading zone and that trucks are authorized, with engines off, for a maximum of 30 minutes" (see sworn report).
  • w)To date, the reported problem continues (undisputed fact).

III.On the specific case. In the case sub examine, it was established that a complaint is being processed before the Municipalidad de Siquirres concerning the problem caused by the parking of freight trucks at commercial establishments in the area, which generates noise pollution and obstruction of the free flow of traffic.

In this regard, the municipal authorities reported that a traffic impact study was conducted in the reported area, in which the Departamento de Infraestructura Vial Cantonal determined the following: "…-That on the sidewalk of the property, yellow-line road marking is observed at the curb; -That in front of the property there is a mini-market; -That on the sidewalk in front of the mini-market, the yellow line has been erased; -That upon arrival, vehicles were found parked in front of the property on both sides of the road; -That in front of the mini-market, trucks were found parked and, throughout the time spent conducting the inspection, they did not turn off their engines…". As a result, an order was issued to include within the municipal work crew's schedule the repainting of the yellow line that was not visible on the block in front of the ice factory.

However, given the disagreement of the representatives of the commercial establishments in the area, on October 15, 2020, the respondent authority agreed to carry out the road marking of the town center, in accordance with the study conducted by the Departamento de Ingeniería de Tránsito, as well as to correct the stretch marked in front of the ice factory.

Furthermore, it is on record that on June 2, 2021, the Departamento de Infraestructura Vial Cantonal requested that the Junta Vial Cantonal draft a Reglamento de Carga y Descarga in order to be able to mark the zones within the canton's town center, which was approved. Currently, that regulation is in its final stage at the Asesoría Legal of the Departamento de Infraestructura Vial Cantonal. However, according to the sworn report, the defendant authority stated that "while the regulation is being finalized—which will regulate and put an end to the solution of this problem—it has been proposed to place signs over the yellow zone indicating that it is a loading and unloading zone and that trucks are authorized, with engines off, for a maximum of 30 minutes."

IV.Based on the foregoing, this Court finds that, although the Municipality of Siquirres has not been indifferent to the problem reported by the protected party (amparada), nor to the grievances expressed by representatives of the commercial establishments in the area — as evidenced by the inspections carried out, the provisional measures (medidas provisionales) adopted, and the existence of a project aimed at correcting the problem affecting the community — the fact remains that, as of the date of this ruling, the reported problem persists.

It is thus established that more than two years have elapsed since the respondent municipality became aware of the situation, without having yet implemented a definitive solution. In this regard, it is clear that the time elapsed is disproportionate and that the delay incurred by the Municipality of Siquirres in arriving at a definitive solution to the problem has affected the fundamental rights (derechos fundamentales) of the inhabitants of the area.

Accordingly, the appropriate course of action is to grant the writ, with the directives to be stated in the operative section (parte dispositiva) of this judgment.

V.Partial dissenting vote (Voto salvado parcial) with respect to the operative section of this judgment by Justice Garro Vargas. While I concur with the majority of the Court that the writ must be granted, I differ as to where the enforcement phase of this matter should be assigned, given the absence of adequate mechanisms provided for by the rules governing this constitutional jurisdiction (jurisdicción constitucional) to monitor a judgment that involves highly complex technical aspects — as is the case here in resolving the problem reported by the appellant relating to noise pollution (contaminación sónica) and obstruction of freedom of movement (libre tránsito), caused by trucks parked in front of her home while loading and unloading at commercial establishments in her neighborhood. In contrast, the provisions of the Código Procesal Contencioso-Administrativo on enforcement (Articles 155 et seq.) offer clear advantages, such as the ability to request timelines, impose fines, assign liability, supervise compliance stages, and so forth. Therefore, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, I find that the enforcement phase should be carried out before the Área de Ejecución of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment enforcement rules of that Code.

VI.Documentation submitted to the case file (expediente). The parties are hereby notified that any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device that may have been submitted, must be retrieved from the court office within a maximum period of 30 business days (días hábiles) from the date of notification of this judgment. Otherwise, all materials not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena at session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, Article LXXXI.

Por tanto:

The writ is granted. Mangell Mc Lean Villalobos, Randall Blake Reid, and William Solano Ocampo — respectively mayor (alcalde), president of the municipal council (presidente del concejo), and Director of the Departamento de Infraestructura Vial Cantonal, all of the Municipality of Siquirres — or whoever holds those positions, are hereby ordered to issue the pertinent directives and carry out all necessary coordination within the scope of their authority so that, within a period of THREE MONTHS from the date of notification of this judgment, the reported problem that is the subject of this writ is resolved. They must likewise inform the appellant of the actions taken to that end. The respondent authorities are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order that they are required to comply with or to enforce, issued within a writ of amparo (recurso de amparo) proceeding, and who fails to comply with or enforce it, provided the offense is not more severely penalized under another provision.

The Municipality of Siquirres is condemned to pay costs, damages, and losses (costas, daños y perjuicios) arising from the acts on which this declaration is based, to be assessed in administrative contentious judgment enforcement proceedings. Justice Garro Vargas dissents with respect to the enforcement of this judgment and, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional, provides that enforcement must be carried out before the Área de Ejecución of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the enforcement rules set forth in Articles 155 et seq. of the Código Procesal Contencioso Administrativo. She likewise orders that a copy of the judgment be forwarded to that body so that enforcement proceedings may be initiated. Notify.

Documento PJEDITOR SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del diecisiete de setiembre de dos mil veintiuno .

Recurso de amparo que se tramita en el expediente n.° 21-014620-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE SIQUIRRES.

Resultando:

  1. 1Por escrito recibido en la Sala el 29 de julio de 2021, la accionante interpone un recurso de amparo. Manifiesta que vive en la comunidad de Siquirres, Dirección01, hace 40 años. Indica que actualmente el desarrollo desmedido y sin control por parte del gobierno local ha ocasionado desorden y caos vial que lesiona los derechos fundamentales de las personas habitantes de esa comunidad. Agrega que el crecimiento económico y comercial sin las medidas pertinentes ha provocado contaminación sónica y ambiental. Refiere que mediante nota del 3 de diciembre de 2019, le indicó al alcalde que la contaminación producida por los camiones que estacionan frente a su casa afecta su salud. No obstante, alega que no recibió respuesta alguna. Asimismo, por nota del 16 de abril de 2020, expuso el problema ante el Concejo, el cual mediante sesión ordinaria No. 208 celebrada el 20 de abril de 2020, lo trasladó a Asuntos Jurídicos.Luego, mediante dictamen No. 154-2020, ese departamento acordó cambiar la demarcación de la calle. Para tal efecto, el jefe de la Delegación de Tránsito de Siquirres realizó varias inspecciones y recomendó, en el punto 5: habilitar un espacio de carga y descarga que reúna las condiciones para que los camiones no obstruyan el paso y en el punto 6: descongestionar la zona denunciada en procura de la salud de las personas. Argumenta que así, mediante escrito DA- 915-2020 del 18 de noviembre de 2020, el alcalde recurrido ordenó demarcar con línea amarilla la zona donde estacionan los camiones frente a su casa sin valorar el interés público. Estima que, ante el crecimiento desmedido de los locales comerciales, la administración municipal debe reservar un espacio para la carga y descarga de los productos con el propósito de evitar el caos vial, el desorden, la contaminación sónica y ambiental que perjudica a todos los habitantes de esa comunidad. Insiste en que en reiteradas ocasiones, las aceras son bloqueadas con mercancías por el congestionamiento vial que producen los camiones que impiden el paso de vehículos, buses y ambulancias.
  2. 2Por resolución de las 17:23 horas del 4 de agosto de 2021 se dio curso al amparo.
  3. 3Informan bajo juramento Mangell Mc Lean Villalobos, Randall Blake Reid y William Solano Ocampo, por su orden alcalde, presidente del concejo y director del Departamento de Infraestructura Vial Cantonal, todos de la Municipalidad de Siquirres. Se refieren a la legislación aplicable. Afirman que las municipalidades tienen competencias para ejercer la señalización vial de los territorios bajo su jurisdicción y administración. Manifiestan que en la sesión extraordinaria n.° 1 del 24 de julio de 2018 se autorizó iniciar el proceso para realizar un estudio de impacto vial con el fin de realizar una nueva demarcación en Siquirres centro. Relatan que, la Junta Vial Cantonal conoció el 4 de junio de 2020 la nota de la recurrente, remitida por el concejo, donde solicitaba reubicar o ubicar la zona de carga y descarga de la fábrica de hielo porque le genera ruido y eso afecta su salud. En esa sesión de Junta Vial se informó que la solicitud de la amparada se encontraba dentro del estudio de impacto vial.El 3 de diciembre de 2019, la alcaldía recibió una nota de la recurrente, solicitando la reubicación aludida. El sitio carecería de demarcación alguna. El 2 de diciembre de 2019 se puso en conocimiento de la policía de tránsito y se advirtió de un enfrentamiento entre el esposo de la recurrente y el propietario de la fábrica de hielo. Remite a la prueba. El 14 de abril de 2020, la Delegación de Tránsito de Siquirres de la Dirección General de Policía de Tránsito del Ministerio de Obras Públicas y Transportes informó a la recurrente que la zona de carga y descarga no contaba con ningún tipo de demarcación (zona amarilla) y se recomendó habilitar esa zona para regular y resolver la problemática. El 16 de abril de 2021, el concejo recibió una misiva de la accionante, donde exponía la problemática. Fue trasladada a la Junta Vial Cantonal. El 22 de junio del 2020, la Junta Vial pone en conocimiento del señor alcalde el acuerdo emitido en la sesión ordinaria Nº 3, artículo VIII de la sesión celebrada el día jueves 4 de junio del 2020, en donde se ordenó realizar el estudio de impacto vial.Posteriormente, el 31 de agosto del 2020, el Departamento de Infraestructura Vial Cantonal, determinó lo siguiente en su informe de inspección: “…-Que en la acera de la propiedad se observa la demarcación con línea amarilla en el borde; - Que frente a la propiedad, esta (sic) ubicado un minisúper, -Que en la acera frente al minisúper, la línea amarilla se encuentra borrada, -Que al momento de llegar se encontraban vehículos parqueados frente a la propiedad en ambos lados de vía, -Que frente al minisúper se encontraban parqueados camiones y durante el tiempo transcurrido realizando la inspección, no apagaron los motores…”. El 2 de setiembre de 2020, la amparada presentó una misiva ante la Junta Vial Cantonal, en la que solicitó la remarcación de la línea amarilla, pues esta se había ido lavando; fue trasladada, mediante el acuerdo n.°202003009-04 a la Dirección del Gestor de Infraestructura Vial.Así, el 3 de setiembre del 2020, en la sesión nº.6-2020, la Junta Vial conoció la nota de la tutelada, y mediante el acuerdo n°.20200309-04, ordenó instruir al ingeniero Solano Ocampo, Encargado del Departamento de Infraestructura Vial Cantonal, incluir dentro de la programación de la cuadrilla municipal repintar la línea amarilla que se no observaba en la cuadra frente a la Fábrica de Hielo. El 5 de octubre del 2020, el municipio recibió una nota suscrita por el señor Ricardo Méndez Salazar, representante legal del Prado del Caribe, así como una nota de los patentados Concentrados para animales Mundo de Mascotas Mi Mejor Amigo, Fotocopiadora CopyPrint y Verdulería Los Campesinos, inquilinos de los locales propiedad del Prado del Caribe, en donde manifiestan su disconformidad con las medidas tomadas por el Departamento de Infraestructura Vial de demarcar con línea amarilla frente a los locales comerciales.Además, se recibió una misiva de los patentados, comerciantes y usuarios del lugar en que se demarcó la línea amarilla en cuestión, en la que se alegaba que la demarcación se había realizado sin ninguna autorización ni ningún estudio técnico, y que ello perjudicaba a la comunidad comerciante de la zona. Lo anterior fue conocido en la sesión ordinaria nº.023 celebrada el 6 de octubre del 2020, fecha en la que el Concejo acordó remitir la misiva a la Alcaldía, para su resolución definitiva. Ante ello, el 15 de octubre del 2020, en la sesión extraordinaria nº. 03-2020, se emitió el acuerdo nº. 20200309-07 en el que se ratificó, en firme y por unanimidad, instruir al ingeniero del Departamento de Infraestructura Vial Cantonal, para que ejecutara la demarcación del casco central, según el estudio realizado por el Departamento de Ingeniería de Tránsito, iniciando la demarcación por las intersecciones, posteriormente los cambios de vía en la zona del Mercado central.Asimismo, mediante el acuerdo n.°20201015-06, se indicó que “con el fin de dinamizar el desarrollo económico local, y proteger el interés público y privado, se instruye al Ingeniero del Departamento de Infraestructura Vial cantonal corregir el tramo pintado frente a la Fábrica de Hielo dejando solo 10 metros demarcados a cada lado de la vía. Consta en imagen 7 y 12 del expediente.”. El 2 de junio del 2021, el ingeniero Solano Ocampo, Director-Gestor del Departamento de Infraestructura Vial Cantonal, solicitó, mediante el oficio JVC-201-046, elaborar un Reglamento de Carga y Descarga para poder demarcar las zonas, en el casco del cantón. Debido a ello, mediante el acuerdo emitido en la sesión ordinaria nº.05 de 3 de junio del 2021, la Junta Vial aprobó esa solicitud. Adiciona lo siguiente: “No es cierto, que exista un desarrollo desmedido y sin control por parte del Gobierno Local. Si bien es cierto, la Municipalidad carece actualmente de Plan Regulador, lo cierto es, que nos encontramos próximos a su aprobación, incluso ya hemos ejecutado la Audiencia Pública del mismo.Esto no quiere decir, que existe un caos vial en nuestro cantón; y que las acciones que se ejecuten, no se basen en normas y criterios técnicos. Conforme consta en los antecedentes de este caso, la Junta Vial Cantonal, aprobó un estudio técnico de impacto vial, el cual fue ratificado en dos ocasiones diferentes. (…) Es cierto parcialmente, que exista alguna contaminación sónica, la cual no ha sido medida en los parámetros técnicos que exige la normativa; y cuya competencia no es del municipio, sino del Ministerio de Salud. (…) Las notas que ha remitido la señora recurrente, han sido abordadas por las oficinas, que los aquí suscritos en diferentes ocasiones; siendo que el último acuerdo de Junta Vial, aprobó levantar la demarcación realizada, sobre el borde de la acera de la aquí recurrente, por encontrarse frente a su casa, demarcada la zona como amarilla, y en ese sentido, demarcar ambos lados de la calle, genera una problemática aún mayor, que es perjudicar todo el sector comercial de la zona.Así las cosas, se ha propuesto colocar rótulos, sobre la zona amarilla, en donde se indique, que es zona de carga y descarga, y que se autorizan los camiones, con el motor apagado, por un máximo de 30 minutos, así como proceder a la elaboración del Reglamento para regular las zonas de carga y descarga, que se encuentra en proceso de presentación, a la Junta Vial Cantonal. (…) No es cierto, que la recurrente no ha recibido respuesta a sus gestiones. En una primera oportunidad, se accedió a la solicitud de la aquí recurrente, y se procedió a demarcar, con instrucciones de la Junta Vial, la zona frente a la vivienda de la recurrente. Sin embargo, los vecinos patentados, se quejaron, así como los usuarios y, en consecuencia, se revocó tal decisión y se optó por los rótulos, que se encuentran en fase de solicitud de elaboración, en el marco de la contratación por demanda, que tenemos, ya en fase de ejecución; la cual se adjunta como prueba documental; mientras se concluye el reglamento, que regulará y pondrá fin a la solución de dicha problemática.En dichos rótulos, se está permitiendo, el parqueo, con el motor apagado, a los fines de resguardar el derecho a la salud de la recurrente, en el sentido de que padece del trastorno de ansiedad. (…) No es cierto, que la Alcaldía no haya sopesado el interés público cantonal, a los fines de valorar la demarcación o no de la zona amarilla. Al contrario, dicho criterios conforme consta en los antecedentes de esta contestación, se hizo con fundamento en la normativa y jurisprudencia administrativa que regula la materia y los estudios técnicos de impacto vial realizados por el municipio, y que fueron aprobados y ratificados por la Junta Vial Cantonal. (…) se debe concluir el proyecto de reglamento de carga y descarga, que regule el uso de esos espacios, tanto para los comerciantes como para los expendedores de productos; el cual como hemos dicho, se encuentra en fase de finalización en la Asesoría Legal del Departamento de Infraestructura Vial Cantonal (…) la policía municipal y la policía de tránsito, entre otras cosas, fiscalizan que las aceras no sean bloqueadas con mercancías. No obstante, el personal con el que se cuenta es poco y se trata de prestar el mejor servicio posible.”.
  4. 4En los procedimientos seguidos se han observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I.Objeto del recurso. La recurrente estima vulnerados sus derechos fundamentales, toda vez que denunció en 2019 a la Municipalidad de Siquirres la contaminación sónica y obstrucción del libre tránsito, ocasionada por los camiones que estacionan frente a su casa, los cuales realizan cargas y descargas en los locales comerciales de su vecindario. Reclama que, a la fecha, esa problemática continúa.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:

  • a)La recurrente es vecina de Siquirres, Dirección01 (hecho incontrovertido).
  • b)El 3 de diciembre de 2019, la amparada interpuso una denuncia en la Municipalidad de Siquirres, en la que expuso lo siguiente: “…estoy viviendo una situación bastante grave y eso con el dueño de la fábrica de hielo (…) tiene dos camiones para carga y descarga de hielo, cuando realiza ese trabajo deja encendido los camiones hasta dos horas consecutivo, lo cual me está causando problemas de salud. (…) solicito la colaboración de usted en conversar con la Policía Municipal para que tomen control del asunto. (…) He tenido que acudir al médico por el problema de salud (…) esta situación me afecta física y emocional (sic) causándome un Trastorno de Ansiedad (sic)…” (ver prueba aportada al expediente digital).
  • c)El 2 de diciembre de 2020, la amparada interpuso una gestión ante la Dirección General de la Policía de Tránsito, en la que solicitó “una orden de prohibición para que los camiones de carga y descarga se acomoden en un lugar donde no ocasione esa alta contaminación sonora (ruido) frente a mi casa, ya que me está ocasionando Trastorno de Ansiedad (sic)…” (ver informe rendido bajo juramento y prueba aportada al expediente digital).
  • d)El 14 de abril de 2020, la Delegación de Tránsito de Siquirres, brindó respuesta a la gestión interpuesta por la tutelada, en la que se le detallaron las acciones realizadas para la atención de la denuncia; además se recomendó “habilitar un espacio de carga y descarga que reúna las condiciones y características para que los camiones que tengan actividad comercial ahí, puedan realizar su maniobra sin obstruir el libre tránsito, dicho espacio podría ser en Dirección02 la cual es de poca circulación vehicular y está a escasos 75 metros de los locales donde actualmente obstruyen el paso de dichos vehículos. Lo que descongestionaría altamente la zona denunciada, buscando con esto guardar la salud de su persona en base al dictamen médico mostrado, donde certifica la patología de Trastorno de Ansiedad. A su vez, se le indica que con la habilitación y calibración del equipo de medición de ruidos, se procederá a la medición de los vehículos de carga que se presentan al lugar para la carga o descarga de mercancías…” (ver prueba aportada al expediente digital).
  • e)El 16 de abril de 2020, la recurrente solicitó al Concejo Municipal de Siquirres la habilitación de un espacio de carga que reuniera las condiciones y características para que los camiones pudieran maniobrar sin obstruir el libre tránsito; además, requirió la demarcación de la zona (ver informe rendido bajo juramento y prueba aportada al expediente digital).
  • f)El 1° de mayo de 2020, la Comisión Permanente de Asuntos Jurídicos de la Municipalidad de Siquirres, mediante el dictamen n.°154-2020, acordó remitir la solicitud de la tutelada a la Junta Vial de ese municipio, a fin de que se analizara la posibilidad de realizar los cambios y demarcaciones solicitados (ver prueba aportada al expediente digital).
  • g)El 21 de mayo de 2020, el alcalde municipal de Siquirres recibió el dictamen n.°154-2020, emitido por la Comisión Permanente de Asuntos Jurídicos de ese municipio (ver prueba aportada al expediente digital).
  • h)El 25 de mayo de 2020, la alcaldía municipal remitió a la Junta Vial Cantonal el acuerdo tomado por la Comisión Permanente de Asuntos Jurídicos, en virtud de la gestión interpuesta por la amparada (ver informe rendido bajo juramento y prueba aportada al expediente digital).
  • i)El 4 de junio de 2020, la Junta Vial Cantonal, mediante la sesión ordinaria nº 3, artículo VIII, conoció la gestión de la tutelada y acordó ordenar un estudio de impacto vial en la zona denunciada (ver informe rendido bajo juramento).
  • j)El 22 de junio de 2020, la Junta Vial Cantonal puso en conocimiento del alcalde municipal el acuerdo tomado el 4 de junio de 2020 (ver informe rendido bajo juramento y prueba aportada al expediente digital).
  • k)Por informe de inspección del 31 de agosto de 2020, el Departamento de Infraestructura Vial Cantonal determinó: “…-Que en la acera de la propiedad se observa la demarcación con línea amarilla en el borde; - Que frente a la propiedad, esta (sic) ubicado un minisúper, -Que en la acera frente al minisúper, la línea amarilla se encuentra borrada, -Que al momento de llegar se encontraban vehículos parqueados frente a la propiedad en ambos lados de vía, -Que frente al minisúper se encontraban parqueados camiones y durante el tiempo transcurrido realizando la inspección, no apagaron los motores…” (ver informe rendido bajo juramento y prueba aportada al expediente digital).
  • l)El 2 de setiembre de 2020, la amparada presentó una misiva ante la Junta Vial Cantonal, solicitando la demarcación de la línea amarilla (ver informe rendido bajo juramento y prueba aportada al expediente digital).
  • m)El 3 de setiembre de 2020, mediante el acuerdo n.°202003009-04, la Dirección del Gestor de Infraestructura Vial, en virtud de la misiva interpuesta por la recurrente, ordenó “indicarle al ingeniero Solano Ocampo, Encargado del Departamento de Infraestructura Vial Cantonal, incluir dentro de la programación de la cuadrilla municipal repintar la línea amarilla que se no observaba en la cuadra frente a la Fábrica de Hielo” (ver informe rendido bajo juramento y prueba aportada al expediente digital).
  • n)El 10 de setiembre de 2020, el Departamento de Infraestructura Vial Cantonal recibió el acuerdo n.° 202003009-04, emitido por la Dirección del Gestor de Infraestructura Vial (ver prueba aportada al expediente digital).
  • o)El 5 de octubre de 2020, el municipio recurrido recibió una nota suscrita por el señor Ricardo Méndez Salazar, representante legal del Prado del Caribe, así como una nota de los patentados “Concentrados para animales Mundo de Mascotas Mi Mejor Amigo”, “Fotocopiadora CopyPrint” y “Verdulería Los Campesinos”, en donde manifiestan su disconformidad con las medidas tomadas por el Departamento de Infraestructura Vial de demarcar con línea amarilla frente a los locales comerciales (ver informe rendido bajo juramento y prueba aportada al expediente digital).
  • p)El 6 de octubre de 2020, el Concejo de Siquirres conoció la misiva interpuesta por el legal del Prado del Caribe, así como la nota de los patentados “Concentrados para animales Mundo de Mascotas Mi Mejor Amigo”, “Fotocopiadora CopyPrint” y “Verdulería Los Campesinos”, y acordó remitir la misma a la Alcaldía para su resolución definitiva (ver informe rendido bajo juramento y prueba aportada al expediente digital).
  • q)El 15 de octubre de 2020, en la sesión extraordinaria nº. 03-2020, la autoridad recurrida emitió el acuerdo nº. 20200309-07 en el que se ratificó, en firme y por unanimidad, “instruir al ingeniero del Departamento de Infraestructura Vial Cantonal, para que ejecutara la demarcación del casco central, según el estudio realizado por el Departamento de Ingeniería de Tránsito, iniciando la demarcación por las intersecciones, posteriormente los cambios de vía en la zona del Mercado central” (ver informe rendido bajo juramento y prueba aportada al expediente digital).
  • r)El 15 de octubre de 2020, en la sesión extraordinaria nº. 03-2020, la autoridad recurrida emitió el acuerdo n.°20201015-06, en que indicó que “con el fin de dinamizar el desarrollo económico local, y proteger el interés público y privado, se instruye al Ingeniero del Departamento de Infraestructura Vial cantonal corregir el tramo pintado frente a la Fábrica de Hielo dejando solo 10 metros demarcados a cada lado de la vía.” (ver informe rendido bajo juramento y prueba aportada al expediente digital).
  • s)El 2 de junio de 2021, el ingeniero Solano Ocampo, Director-Gestor del Departamento de Infraestructura Vial Cantonal solicitó a la Junta Vial Cantonal, mediante el oficio JVC-201-046, elaborar un Reglamento de Carga y Descarga para poder demarcar las zonas, en el casco del cantón.” (ver informe rendido bajo juramento y prueba aportada al expediente digital).
  • t)El 3 de junio de 2021, la Junta Vial Cantonal aprobó la solicitud del Director-Gestor del Departamento de Infraestructura Vial Cantonal (ver informe rendido bajo juramento).
  • u)Actualmente, la autoridad recurrida carece de un Plan Regulador, el cual está próximo a su aprobación; asimismo, está pendiente la conclusión del proyecto de Reglamento de carga y descarga en la zona, en cual está en fase de finalización en la Asesoría Legal del Departamento de Infraestructura Vial Cantonal (ver informe rendido bajo juramento).
  • v)Según informe rendido “mientras se concluye el reglamento, que regulará y pondrá fin a la solución de dicha problemática, se ha propuesto colocar rótulos, sobre la zona amarilla, en donde se indique, que es zona de carga y descarga, y que se autorizan los camiones, con el motor apagado, por un máximo de 30 minutos” (ver informe rendido bajo juramento).
  • w)A la fecha, la problemática denunciada continúa (hecho incontrovertido).

III.Sobre el caso concreto. Del sub examine, se tuvo por demostrado que ante la Municipalidad de Siquirres se tramita una denuncia, en virtud de la problemática ocasionada por el estacionamiento de camiones de carga en los locales comerciales en la zona, lo que provoca contaminación sónica y obstrucción del libre tránsito.

Al respecto, las autoridades municipales informaron que se realizó estudio de impacto vial en la zona denunciada, en el que el Departamento de Infraestructura Vial Cantonal, determinó lo siguiente: “…-Que en la acera de la propiedad se observa la demarcación con línea amarilla en el borde; - Que frente a la propiedad, esta (sic) ubicado un minisúper, -Que en la acera frente al minisúper, la línea amarilla se encuentra borrada, -Que al momento de llegar se encontraban vehículos parqueados frente a la propiedad en ambos lados de vía, -Que frente al minisúper se encontraban parqueados camiones y durante el tiempo transcurrido realizando la inspección, no apagaron los motores…”. Debido a esto, se ordenó incluir dentro de la programación de la cuadrilla municipal repintar la línea amarilla que se no observaba en la cuadra frente a la Fábrica de Hielo.

No obstante, dada la disconformidad de los representantes de los locales comerciales de la zona, el 15 de octubre de 2020, la autoridad recurrida acordó la ejecución de la demarcación del casco central, según el estudio realizado por el Departamento de Ingeniería de Tránsito, así como la corrección del tramo demarcado frente a la Fábrica de Hielo.

Por otro lado, consta que el 2 de junio de 2021, el Departamento de Infraestructura Vial Cantonal solicitó a la Junta Vial Cantonal la elaboración de un Reglamento de Carga y Descarga para poder demarcar las zonas, en el casco del cantón, lo cual fue aprobado. Actualmente, ese reglamento está en fase de finalización en la Asesoría Legal del Departamento de Infraestructura Vial Cantonal. Sin embargo, según el informe rendido bajo juramento, la autoridad accionada manifestó que “mientras se concluye el reglamento, que regulará y pondrá fin a la solución de dicha problemática, se ha propuesto colocar rótulos, sobre la zona amarilla, en donde se indique, que es zona de carga y descarga, y que se autorizan los camiones, con el motor apagado, por un máximo de 30 minutos”.

IV.De lo expuesto, este Tribunal estima que, si bien la Municipalidad de Siquirres no ha desatendido la problemática denunciada por la amparada, así como las disconformidades de los representantes de los locales comerciales de la zona, ello al comprobarse que han trabajado en la búsqueda de soluciones, como lo son la realización de inspecciones, la toma de medidas provisionales y la existencia de un proyecto, tendiente a corregir el problema que afecta la comunidad; lo cierto es que, a la fecha la problemática denunciada continúa.

Así, se acredita que han transcurrido más de dos años desde que el municipio accionado tiene conocimiento de la situación, sin que haya implementado todavía una solución definitiva. En ese sentido, es claro que el plazo transcurrido es desproporcionado y que la dilación en la que ha incurrido la Municipalidad de Siquirres en dar una solución definitiva a la problemática ha afectado los derechos fundamentales de los habitantes de la zona.

En consecuencia, lo procedente es acoger el recurso, con las indicaciones que se dirán en la parte dispositiva de esta sentencia.

V.Voto salvado parcial respecto a la parte dispositiva de esta sentencia de la Magistrada Garro Vargas. Si bien coincido con la mayoría de la Sala en que el recurso se debe declarar con lugar, difiero sobre dónde residenciar la fase de ejecución del asunto, debido a la inexistencia de mecanismos adecuados previstos por la normativa que rige esta jurisdicción constitucional para dar seguimiento a una sentencia que reviste aspectos técnicos de gran complejidad, como es en este caso solucionar el problema denunciado por la parte recurrente relacionado con la contaminación sónica y obstrucción del libre tránsito, ocasionada por los camiones que estacionan frente a su casa, los cuales realizan cargas y descargas en los locales comerciales de su vecindario. En cambio, lo dispuesto por el Código Procesal Contencioso-Administrativo en materia de ejecución (artículo 155 y siguientes) tiene evidentes ventajas, como la posibilidad de pedir cronogramas, imponer multas, sentar responsabilidades, fiscalizar etapas de cumplimiento, etc. Por ello, de conformidad con lo dispuesto por el artículo 56 de la Ley de Jurisdicción Constitucional, estimo que la fase de ejecución debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución de sentencia de dicho Código.

VI.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Mangell Mc Lean Villalobos, Randall Blake Reid y William Solano Ocampo, por su orden alcalde, presidente del concejo y director del Departamento de Infraestructura Vial Cantonal, todos de la Municipalidad de Siquirres, o a quienes ejerzan esos cargos, que giren las ordenes pertinentes y efectúen las coordinaciones necesarias en el ámbito de sus competencias para que, dentro del plazo de TRES MESES, contado a partir de la notificación de esta sentencia, se resuelva la problemática denunciada, objeto de este recurso. Asimismo, deberán comunicar a la recurrente las acciones realizadas al efecto. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de Siquirres al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La Magistrada Garro Vargas salva el voto respecto a la ejecución de esta sentencia y, de conformidad con el artículo 56 de la Ley de la Jurisdicción Constitucional, dispone que debe realizarse ante el Área de Ejecución del Tribunal Contencioso Administrativo y Civil de Hacienda, bajo las reglas de ejecución, establecidos en los artículos 155 y siguientes del Código Procesal Contencioso Administrativo. Asimismo, ordena que se le remita copia de la sentencia para que se inicie los procedimientos de ejecución de este fallo. Notifíquese.
