Action of unconstitutionality (acción de inconstitucionalidad) filed by Nombre01, holder of identity card no. CED01, against Law no. 9838, “AMENDMENT TO LAW 9078, LAW ON TRAFFIC ON PUBLIC LAND ROADS AND ROAD SAFETY, OF 4 OCTUBRE DE 2012, TO ESTABLISH VEHICULAR RESTRICTIONS IN CASES OF A PREVIOUSLY DECLARED NATIONAL EMERGENCY,” Article 95 bis of Law no. 9078, added by Article 1 of Law no. 9838, Executive Decree no. 43.048 of 10 de junio de 2021, which amended Transitory Provision X of Executive Decree no. 42.295-MOPT-S, and Executive Decree no. 42.227-MP-S.

Background:

  1. 1By a written submission received by this Chamber on 25 de agosto de 2021, the petitioner requests that Law no. 9838, “AMENDMENT TO LAW 9078, LAW ON TRAFFIC ON PUBLIC LAND ROADS AND ROAD SAFETY, OF 4 OCTUBRE DE 2012, TO ESTABLISH VEHICULAR RESTRICTIONS IN CASES OF A PREVIOUSLY DECLARED NATIONAL EMERGENCY,” Article 95 bis of Law no. 9078, added by Article 1 of Law no. 9838, Executive Decree no. 43.048 of 10 de junio de 2021, which amended Transitory Provision X of Executive Decree no. 42.295-MOPT-S, and Executive Decree no. 42.227-MP-S be declared unconstitutional for violating Articles 7 and 21 of the Political Constitution, as well as the constitutional principles of reasonableness, temporariness, and proportionality. The petitioner alleges that the challenged legislation prevents him from exercising his constitutional right to travel freely in his vehicle throughout the national territory, insofar as a monetary penalty (sanción pecuniaria) of ¢ 110,729.29 colones has been incorporated into the legal system for those who violate the restriction on vehicular travel on land roads.He states that the crisis caused by COVID-19 led the affected countries to adopt extraordinary measures, and our country was no exception. He adds that on 16 de marzo del 2020, a state of National Emergency was declared throughout the territory of Costa Rica by means of Decree no. 42227-MP-S. He asserts that the National Emergencies and Risk Prevention Law (Law no. 8488) provides as follows in Article 34: “Power to impose temporary restrictions. Under a state of emergency, the Executive Branch may decree temporary restrictions on land use in order to prevent major disasters and facilitate the construction of works. For the same reasons, it shall take such measures as it deems necessary to permit the evacuation of persons and property. It may likewise impose restrictions on habitability, transit, and the exchange of goods and services in the affected region. The specific and temporary restriction of the guarantees indicated in this article may not exceed a period of five calendar days.The Legislative Assembly has exclusive authority to suspend the fundamental rights provided for in subsection 7) of Article 121 of the Political Constitution” (the underlining and highlighting are not in the original). He complains that, through Decree no. 42227-MP-S, a series of measures have been issued, including resolutions of the Ministerio de Salud, without sufficient technical basis, which are manifestly in violation of civil liberties, have seriously affected thousands of business ventures, and have caused mass layoffs, as well as the suspension of employment contracts in the private sector. These measures are justified on the basis of the need to protect the right to life, but, on the contrary, they force people to use public transportation or other paid passenger transportation services, such as taxis, which transport large numbers of people every day without any genuine and effective oversight of compliance with health measures in those vehicles; this therefore has an adverse effect and instead jeopardizes their health and puts their lives at risk.Consequently, restricting the use of one’s personal vehicle, far from protecting one’s life or public health, places them at risk, thereby violating the principle underlying the possibility of restricting or suspending rights, which must be related to the protection of another, superior constitutional right. He claims that a series of international human-rights rules and treaties are being violated. This type of limitation on the exercise of a fundamental right prevents the exercise of other rights: assembly, education, expression, and the pursuit of economic, commercial, and professional activities. Such restrictions on fundamental rights must be established by law, that is, by the Asamblea Legislativa; the Executive Branch may not invoke its ordinary powers to impose such limitations, as it does with freedom of movement, because the restriction is wholly disproportionate, having been extended under the pretext of the pandemic without any scientifically proven justification for its application and necessity.The restrictions on civil liberties, although justified by the characteristics of the pandemic (despite lacking technical and scientific criteria), were adopted through powers not contemplated by the Constitution for that purpose. The duration and continuation of those limitations are uncertain, as is the presence of the virus. It must not be overlooked that decrees declaring a state of emergency are subject, like all other decrees and rules, to the review of constitutionality and legality prescribed by the legal system. He cites Constitutional Chamber decision no. 3410-92. He states that, according to that decision, the development of the content of Article 180 of the Political Constitution has the clear objective of applying an exceptional regime, which is not accompanied by the execution of spurious and substantively empty acts that merely reflect an abuse of power and an undermining of the democratic system.He complains that the pandemic situation in which we find ourselves was invoked as the basis for the Asamblea Legislativa to approve the bill that became Law no. 9838, whose basic characteristics are: a) expedited processing, without any form of publicity, assessment, institutional consultation, or debate; b) it curtails fundamental rights and freedoms indefinitely, because it requires people to refrain from traveling by motor vehicle for an indeterminate period, subject to the shifting terms of an executive decree; c) it establishes a disproportionate increase in fines for violating vehicular restrictions, which rose from ₡22.383,18 to almost ₡111.000,00 at present, representing an increase of almost 500% over the previous fine for noncompliance with the time-based vehicular restriction in the GAM contained in the Traffic Law. He adds that Article 7 of our Political Constitution provides that international agreements approved by the Asamblea Legislativa shall, upon promulgation, have authority superior to that of statutes, and that because Costa Rica is subject to the Corte Interamericana de Derechos Humanos, it must adhere to its legal framework, which established in Article 27, subsection 1, of the American Convention on Human Rights that guarantees may be suspended only “…provided that such measures are not inconsistent with its other obligations under international law…”; consequently, suspending the use of private vehicles during certain hours or on certain days violates the protection of the right to human life, which constitutes a clear contradiction and breaches the obligation undertaken before the Human Rights Court and promulgated in Article 3 of the Universal Declaration of Human Rights and Article 21 of the Political Constitution of Costa Rica.Furthermore, the Declaration of the Corte Interamericana de Derechos Humanos provides that “…All measures adopted by States to address this pandemic that may affect or restrict the enjoyment and exercise of human rights must be limited in time, lawful, aligned with objectives defined according to scientific criteria, reasonable, strictly necessary and proportionate, and consistent with the other requirements developed in Inter-American human rights law…”. These criteria are not met, and Article 7 of the Political Constitution is therefore violated. He insists that the health-related vehicular restriction (restricción vehicular sanitaria) does not entirely prevent him from traveling, but only from using his vehicle. When he needs to travel to certain places, he will have to do so by public transportation, whether collective transportation or taxi service. If he travels by collective transportation, he will be forced to expose himself not only to dozens of people while waiting a considerable amount of time for transportation, during which other people will also be waiting for other transportation or traveling along the road, but also, as with taxis, to remain in an enclosed vehicle with people whom he does not know and with whom he has no relationship, thereby even forcing him to break the so-called social bubbles; moreover, there is no one inside the vehicle who is genuinely responsible for ensuring that the other persons who have also used the service comply with health measures, physical distancing, or hand-cleaning requirements.If he used his private vehicle, he would travel with his bubble and under fully controlled sanitary conditions, which the vehicular restriction denies him, thereby also violating Article 21 of the Political Constitution, putting his life at risk, and preventing him from taking the proper measures to protect himself. He alleges that there is no scientific criterion that justifies and proves that the use of private vehicles contributes to the spread of COVID-19. The health-related vehicular restriction limits the use of certain private vehicles but not the use of rental vehicles or public transportation; therefore, the restriction is not intended to limit or prevent people’s mobility, but instead encourages the breaking of social bubbles through the use of vehicles belonging to other owners that are also used by many other unknown persons. The measure therefore also fails to satisfy the reasonableness criterion required by the Human Rights Court.Nor is it reasonable to permit travel during the day, when more people are outside their homes and in public places, while restricting travel at night, when the number of people present decreases considerably and contact with potentially infected persons is therefore reduced. The hours of the health-related vehicular restriction correspond to the same hours as the restrictions on businesses. The closure of businesses does prevent people from traveling, so a measure prohibiting them from using their personal vehicles is unnecessary to prevent mobility, because the business-closure measure already accomplishes that purpose. Accordingly, the measure also fails to satisfy the requirement that it be strictly necessary, as required by the Corte Interamericana de Derechos Humanos. On the foregoing grounds, he requests that this action of unconstitutionality be granted.
  2. 2By an order (resolución) issued at 15:15 hours on 26 de agosto de 2021, the petitioner (accionante) was directed that “within a period of TRES DÍAS, counted from the day following service of this order and with the warning that processing of the action will be denied in the event of noncompliance, he must have the filing initiating the action authenticated, and must also clarify the standing (legitimación) he holds to bring this action of unconstitutionality (acción de inconstitucionalidad); and, if there is a prior matter pending resolution in which the unconstitutionality of the challenged provision was invoked—before the action was filed—as a reasonable means of protecting the right or interest he considers infringed, he must provide a verbatim certified copy of the pleading in which the unconstitutionality of the provision was invoked in the underlying matter and establish the procedural status of that matter. The foregoing is pursuant to Articles 75, 79, and 80 of the Ley de la Jurisdicción Constitucional.”
  3. 3In a filing received by this Chamber on 31 de agosto de 2021, the petitioner states that his standing to file this action is based on the second paragraph of Article 75 of the Ley de la Jurisdicción Constitucional. He again submits the filing initiating the action, with amendments, in which he alleges that he brings the action in his “capacity as a person harmed by the public-health vehicle restriction because I am unable to use my personal vehicle during certain hours and days.” He also states that his standing to bring this action of unconstitutionality is based on the second paragraph of Article 75 of the Ley de la Jurisdicción Constitucional, “in defense of a diffuse interest (interés difuso).” He asserts that the challenged provision causes “harm to or affects a diffuse interest by restricting citizens’ freedom to travel in their private vehicles and imposing disproportionate fines on them.”
  4. 4Article 9 of the Ley de la Jurisdicción Constitucional empowers the Chamber, at any time, including upon initial filing, to summarily dismiss (rechazar de plano) or dismiss on the merits any application submitted for its consideration that is manifestly inadmissible, when it determines that sufficient grounds exist to dismiss it, or when it is merely a repetition or reproduction of an identical or similar application previously dismissed.

Justice Castillo Víquez authors the opinion; and,

Considering:

I. REQUIREMENTS AND FORMALITIES OF AN ACTION OF UNCONSTITUTIONALITY

This Chamber has repeatedly held that an action of unconstitutionality is a proceeding subject to certain formalities which, if not satisfied, prevent this Court from ruling on the merits of the matter. Article 75 of the Ley de la Jurisdicción Constitucional governs standing to bring actions of unconstitutionality and provides for different circumstances. The first paragraph requires the existence of a matter pending resolution, whether before a court—including habeas corpus or amparo proceedings—or before an administrative authority—in proceedings to exhaust administrative remedies (agotamiento de la vía administrativa)—in which the unconstitutionality of the challenged provision has been invoked as a reasonable means of protecting the right or interest considered infringed in the principal matter. The second and third paragraphs govern a direct action (acción directa)—for which no underlying matter is required—in the following circumstances: a) when, because of the nature of the matter, there is no individual and direct injury; b) when the action concerns the defense of diffuse interests or interests affecting the community as a whole; and c) when the action is brought by the Procurador General de la República, the Contralor General de la República, the Fiscal General de la República, or the Defensor de los Habitantes. In Judgment No. 04190-95, issued at 11:33 hours on 28 de julio de 1995, this Court clarified that an action of unconstitutionality is:

“(…) a proceeding of an incidental nature (naturaleza incidental), rather than a direct or popular action (acción popular), meaning that there must be a matter pending resolution—whether before the courts or in proceedings to exhaust administrative remedies—in order to obtain access to constitutional review, and the action must constitute a reasonable means of protecting the right considered infringed in the principal matter, such that the Constitutional Court’s ruling has a positive or negative effect on that pending proceeding because it addresses the constitutionality of the provisions that must be applied in that matter; only by way of exception does the law permit direct access to this avenue—the circumstances provided for in the second and third paragraphs of Article 75 of the Ley de la Jurisdicción Constitucional….” Consistent with the foregoing, this Chamber has stated that “the action proceeding is primarily incidental in nature; therefore, for the action to proceed, there must be a matter pending resolution through administrative channels—in the administrative procedure challenging the final act—or through judicial channels.

Thus, only in the exceptional cases established by law will that requirement not be necessary” (Judgment No. 2018-018560, issued at 9:20 hours on 7 de noviembre de 2018). It has also clarified that “the circumstances set forth in paragraph 2o. of Article 75 constitute an exception to the rule established in paragraph 1o. (incidental avenue) and must be carefully assessed” (Judgment No. 2018-008413, issued at 9:20 hours on 30 de mayo de 2018).

II. INADMISSIBILITY OF THIS ACTION OF UNCONSTITUTIONALITY

In response to the directive issued by this Chamber in the order entered at 15:15 hours on 26 de agosto de 2021, the petitioner argues that his standing to bring this action of unconstitutionality is based on the second paragraph of Article 75 of the Ley de la Jurisdicción Constitucional, “in defense of a diffuse interest.” He expressly states that he brings the action in his “capacity as a person harmed by the public-health vehicle restriction because he is unable to use his personal vehicle during certain hours and days.” He also alleges the existence of “harm to or an impact on a diffuse interest by restricting citizens’ freedom to travel in their private vehicles and imposing disproportionate fines on them.” It is therefore apparent that the petitioner’s claim on the merits is intended to challenge the imposition of the restriction on vehicular travel for reasons of national emergency, with the resulting possibility that a traffic fine may be imposed on those specific or identifiable drivers who violate that restriction, since the petitioner alleges that it prevents him from using his private vehicle.

It follows that he seeks to challenge regulations that are clearly capable of individual application. In such cases, this Court has held by majority that when a provision is capable of individual application, diffuse interests may not be invoked to obtain admission of the action. Thus, recently, when considering an analogous case seeking to challenge the same regulations at issue in the case sub judice (specifically, Article 95 bis of Law No. 9078 and Executive Decree No. 42.295-MOPT-S), likewise on the basis of a purported defense of a diffuse interest, this Chamber ruled as follows in Judgment No. 2021-09112, issued at 13:16 hours on 5 de mayo de 2021:

“III.- STANDING DERIVED FROM THE DEFENSE OF DIFFUSE AND COLLECTIVE INTERESTS (INTERESES COLECTIVOS). As a second basis for standing, the petitioner alleges the defense of diffuse and collective interests. However, this Court has held by majority that when a provision is capable of individual application, the defense of diffuse or collective interests may not be invoked to obtain admission of the action. Thus, for example, in Voto No. 2018-18563, issued at 9:20 hours on 7 de noviembre de 2018, this Chamber stated:

“(…) the challenged regulations are capable of individual application, directly affecting the legal sphere of specific persons. Accordingly, the petitioners may be the subjects of acts giving rise to claims through administrative or judicial channels, and in such cases it is not feasible to allege direct standing through the defense of diffuse interests.” Likewise, in Judgment 2020-4490, issued at 9:20 hours on 4 de marzo de 2020, the Chamber stated:

“… Based on the foregoing, because the provisions challenged here could give rise to claims by persons who are readily ascertainable and identifiable within criminal proceedings, this cannot be deemed a circumstance involving the defense of diffuse interests. Indeed, allowing the petitioner to bring an action of unconstitutionality in this matter under the conditions she seeks would amount to recognizing the existence of a popular action, which, as the Constitutional Chamber has stated in its consistent case law (see Judgment No. 2016-000787, issued at 9:05 hours on 20 de enero de 2016), is incompatible with the framework of procedural powers vested in this Constitutional Court in its role as the ultimate interpreter and guardian of the Constitution. Consequently, because it has been established that the petitioner has neither based her standing on the existence of a matter pending resolution in which the unconstitutionality of the provisions challenged here was invoked nor established standing to bring a direct action in defense of diffuse interests, this action is inadmissible.” The reasoning set forth in the partially transcribed decisions applies to the case sub judice, because it is public and notorious that, as regards the applicability of the executive decree, acts issued by the Public Administration may be challenged through administrative channels during the exhaustion phase or, failing that, before the ordinary Courts of the Republic, whether before traffic judges or the contentious-administrative courts (tribunales de lo contencioso-administrativo).

The petitioner should note that, pursuant to the first paragraph of Article 75 of the Ley de la Jurisdicción Constitucional, the rule established by the legislature is that, to have standing to institute an action of unconstitutionality, there must be an underlying proceeding in which the challenged provision is disputed and the action must constitute a reasonable means of protecting the right at issue in that proceeding. In addition to the foregoing, a diffuse interest cannot be equated with a collective interest, because the former is neither so general that it affects the entire community nor so specific that it affects only one person; rather, it is an interest affecting a group that is not formally organized. The latter, meanwhile, has been equated by this Court with a corporate interest and, only in highly exceptional cases, with interests affecting the entire community (see Judgment N.° 8239-01, in which the concept of interests affecting the community is associated with the protection of assets over which the subjects are holders of sovereignty.

“It is therefore not the case that any person may apply to the Constitutional Chamber to protect any interests whatsoever (popular action); rather, every individual may act in defense of those assets that affect the entire national community”); however, this position has not been predominant in this Chamber’s case law in recent years.” These considerations apply to the case under review; therefore, this action is inadmissible and must be summarily dismissed, as hereby ordered.

III. NOTE BY JUSTICE GARRO VARGAS

In judgment n.°2021-09112, invoked by the majority to dismiss the present action, I issued a separate note in which I outlined my interpretation regarding the admissibility of actions alleging a purported diffuse interest (interés difuso) that, instead, should be framed as a case in which there clearly may be a pending matter for resolution (asunto pendiente de resolución) serving as an incidental mechanism for recognizing standing (legitimación) to bring an action of unconstitutionality (acción de inconstitucionalidad). In that judgment, I made the following observations:

“In this matter, I have joined in the decision declaring the action of unconstitutionality inadmissible. However, I have chosen to issue a separate note in order to outline my position regarding standing and the admissibility of this particular proceeding. In that regard, I consider it necessary to clarify that the majority’s decision does not mean that it may be accepted—as a general rule—that whenever there may be a claim concerning an individual and direct violation, it necessarily follows that diffuse interests should not also be protected. In other words, there will be cases in which, given the substantive legal situation affected, both circumstances may arise. A different case exists where it may reasonably be inferred that, although a diffuse interest is alleged, what underlies the claim is a clear personal and individual benefit of a different nature or even another individual right (derecho subjetivo) that does not simultaneously encompass the protection of diffuse interests.

Likewise, the defense of diffuse interests may not be asserted so broadly and abstractly that it becomes confused with a type of citizen action (acción popular), which has been barred by the precedents of this Chamber. For example, judgment n.°2016-5589 challenged a legislative omission to establish, in the Ley General de Ferrocarriles, adequate safety measures for citizens who are pedestrians and drivers. As relevant here, the Chamber ruled as follows:

“it cannot be found that this case involves diffuse interests. Although the petitioner maintains that the alleged omission jeopardizes the safety of all ‘citizen-pedestrians’ and ‘citizen-drivers,’ the fact remains that this cannot be regarded as a group or category possessing the particular characteristics described in the precedents partially transcribed above; on the contrary, the purported collective is so broad, imprecise, and diffuse that it is simply identified with the national community as a whole. Accordingly, it must be reiterated, as this Chamber has held, that a diffuse interest must not be so diluted that it becomes indistinguishable from the national community; that is, ‘it cannot become so broad and generic that it is confused with the interest recognized in all members of society to safeguard constitutional legality’ (see judgment No. 0360-99, cited above). Indeed, allowing the petitioner to bring an action of unconstitutionality in this matter under the conditions sought would ultimately amount to recognizing the existence of a citizen action, which, as the Sala Constitucional has stated in its consistent case law (see judgment No. 2016-000787 at 9:05 hrs. on 20 de enero de 2016), is incompatible with the framework of procedural powers vested in this Tribunal Constitucional in its role as the ultimate interpreter and guardian of the Constitution.” (Emphasis not in the original).

Ultimately, it does not appear valid to use the ‘guise’ of a diffuse interest to ensure the admissibility of an action of unconstitutionality when it can be established that the actual aim is to safeguard other types of rights or interests that could indeed be protected through an action of unconstitutionality, but under the circumstance contemplated in art. 75, paragraph 1°, of the Ley de la Jurisdicción Constitucional.” I likewise consider these observations applicable to the present case, in which no prior matter was invoked as the basis for standing to challenge the restriction on vehicular traffic along land routes.

IV. DIFFERENT REASONS OF JUSTICE RUEDA LEAL

Diffuse interests are those held by a community of persons that is not formally organized but whose association arises from a social need, a physical characteristic, ethnic origin, a personal or ideological orientation, the consumption of a particular product, etc. In such cases, the interest is dispersed or diluted among an unidentified plurality of persons; in this regard, in light of paragraph 2°, of ordinal 75 of the Ley de la Jurisdicción Constitucional, a constitutional challenge based on this type of interest must necessarily relate to that plurality, in the terms stated above. This Chamber has listed various constitutional interests and rights in relation to which a diffuse interest may be asserted, such as a healthy and ecologically balanced environment, cultural heritage, the country’s territorial integrity, the proper management of public spending, and consumer rights, among others.

In this regard, the following clarifications must be made. On the one hand, the aforementioned interests and rights transcend the individual or corporate sphere because they concern the public at large; thus, environmental damage does not affect only the residents of a region but harms or seriously endangers the right of the entire country—and, depending on its magnitude, even humanity as such—to a healthy and ecologically balanced environment. Similarly, defending the proper management of public funds authorized in the Presupuesto de la República reflects an interest of all inhabitants of Costa Rica, not merely of a specific group.

The distinction is not simple; nevertheless, a point of balance must certainly be sought so that diffuse interests, as described above, receive constitutional protection without the concept being extended to such an extent that it creates a citizen action in the various constitutional proceedings, except as provided in article 105 of the Ley de Biodiversidad. For these purposes, the constitutional judge must assess each case individually in order to determine whether the interest in a particular matter has such a degree of significance, and whether the alleged issue disperses its harmful effects so broadly, as to justify finding an interest that concerns the community at large.

With respect to the foregoing, it must be noted that the mere fact that a challenged rule or directive, when it is the subject of a constitutional action proceeding, may be applied individually and directly affect the legal sphere of specific, identifiable persons does not rule out a diffuse interest, since there are situations in which a particular interest converges with the latter. For example, consider a provision that exempted work on a structure declared cultural heritage from preservation requirements; in such a matter, that measure would affect diffuse interests because its harmful consequences would spread throughout an entire community, without preventing an individual who regularly visits the site from also and simultaneously suffering personal harm and bringing a claim. Ergo, the existence of a diffuse interest does not preclude an individual from suffering an injury to their particular interests, even one more significant than that suffered by people generally.

Furthermore, application of the pro-action principle (principio pro actione) also calls for rules to be interpreted in a manner favorable to the protection of fundamental rights and the safeguarding of constitutional supremacy. Accordingly, standing based on diffuse interests is proper regardless of whether the challenged provision or act is susceptible to individual application. In the case at hand, however, I do not find that any of the diffuse interests developed in the case law are present and, for that reason, I reject standing on that basis.

V. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.

Por tanto:

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del ocho de setiembre de dos mil veintiuno .

Acción de inconstitucionalidad promovida por Nombre01, portador de la cédula de identidad nro. CED01, contra la Ley nro. 9838, “MODIFICACIÓN DE LA LEY 9078, LEY DE TRÁNSITO POR VÍAS PÚBLICAS TERRESTRES Y SEGURIDAD VIAL, DE 4 OCTUBRE DE 2012, PARA ESTABLECER LA RESTRICCIÓN VEHICULAR EN CASOS DE EMERGENCIA NACIONAL PREVIAMENTE DECRETADA”, el artículo 95 bis de la Ley nro. 9078, adicionado por el artículo 1 de la Ley nro. 9838, el Decreto Ejecutivo nro. 43.048 del 10 de junio de 2021, el cual modificó el transitorio X del Decreto Ejecutivo nro. 42.295-MOPT-S, y el Decreto Ejecutivo nro. 42.227-MP-S.

Resultando:

  1. 1Por escrito recibido en esta Sala el 25 de agosto de 2021, el accionante solicita que se declare la inconstitucionalidad de la Ley nro. 9838, “MODIFICACIÓN DE LA LEY 9078, LEY DE TRÁNSITO POR VÍAS PÚBLICAS TERRESTRES Y SEGURIDAD VIAL, DE 4 OCTUBRE DE 2012, PARA ESTABLECER LA RESTRICCIÓN VEHICULAR EN CASOS DE EMERGENCIA NACIONAL PREVIAMENTE DECRETADA”, el artículo 95 bis de la Ley nro. 9078, adicionado por el artículo 1 de la Ley nro. 9838, el Decreto Ejecutivo nro. 43.048 del 10 de junio de 2021, el cual modificó el transitorio X del Decreto Ejecutivo nro. 42.295-MOPT-S, y el Decreto Ejecutivo nro. 42.227-MP-S, por infracción a los artículos 7 y 21 de la Constitución Política, así como los principios constitucionales de razonabilidad, temporalidad y proporcionalidad. Alega, el accionante, que la normativa impugnada le impide ejercer su derecho constitucional a movilizarse libremente en su vehículo por el territorio nacional, en tanto se ha incorporado al ordenamiento jurídico una sanción pecuniaria de ¢ 110,729.29 colones, para quienes infrinjan la restricción a la circulación vehicular por vías terrestres.Indica que la crisis ocasionada por la COVID-19 hizo que los países afectados tomaran medidas extraordinarias, no siendo nuestro país la excepción. Añade que el 16 de marzo del 2020 se declaró estado de Emergencia Nacional en todo el territorio de Costa Rica por medio del Decreto nro. 42227-MP-S. Afirma que la Ley Nacional de Emergencias y Prevención del Riesgo (Ley nro. 8488) establece en su artículo 34 lo siguiente: “Potestad de imponer restricciones temporales. Bajo estado de emergencia, el Poder Ejecutivo podrá decretar restricciones temporales en el uso de la tierra, con el fin de evitar desastres mayores y facilitar la construcción de obras. Por las mismas razones, tomará las medidas que considere necesarias para permitir la evacuación de personas y bienes. Igualmente, podrá emitir restricciones sobre habitabilidad, tránsito e intercambio de bienes y servicios en la región afectada.La restricción concreta y temporal de las garantías señaladas en este artículo, no podrá exceder el plazo de cinco días naturales. Corresponde a la Asamblea Legislativa, en forma exclusiva, la suspensión de los derechos fundamentales previstos en el inciso 7) del artículo 121 de la Constitución Política” (el subrayado y resaltado no es del original). Reclama que, mediante el Decreto nro. 42227-MP-S, se han emitido una serie de acciones, que incluyen resoluciones del Ministerio de Salud, sin mayor criterio técnico, que a todas luces son violatorias de libertades públicas, han afectado gravemente a miles de emprendimientos y han provocado despidos masivos, así como suspensión de contratos laborales en el sector privado. Estas medidas se excusan en la necesidad de defender el derecho a la vida, pero, por el contrario, obligan a las personas a utilizar el transporte público o los demás servicios de transporte remunerado de personas, como los taxis, los cuales transportan gran cantidad de personas diariamente, sin que haya una fiscalización real y efectiva del cumplimiento de medidas sanitarias en ellos, por lo que esto causa un efecto adverso y más bien compromete su salud y pone en riesgo su vida, por lo que la restricción de utilizar su vehículo personal lejos de proteger su vida o la salud pública la pone en riesgo, por lo que se viola el principio por el cual se fundamenta la posibilidad de restricción o suspensión de derechos, que debe estar relacionado con la protección de otro derecho constitucional mayor.Acusa que se infringen una serie de normas y tratados internacionales correspondientes a derechos humanos. Este tipo de limitaciones al ejercicio de un derecho fundamental, impide el ejercicio de otros derechos: reunión, educación, expresión y al ejercicio de actividades económicas, comerciales y profesionales. Esta restricción de los derechos fundamentales debe fijarlos la ley, es decir la Asamblea Legislativa; el Ejecutivo no puede invocar sus competencias ordinarias para imponer esas limitaciones, tal y como lo hace a la libertad de tránsito, pues es totalmente desproporcionada, ya que se ha extendido con la excusa de la pandemia, sin que medie una justificación con una base científicamente comprobada de su aplicación y necesidad. Las restricciones a las libertades públicas, aunque justificadas por las características de la pandemia (no contando con criterios técnicos y científicos), se adoptaron a través de facultades no contempladas por la Constitución para ese efecto.La duración y permanencia de esas limitaciones es incierta, como lo es la presencia del virus. No debe dejarse de lado el hecho de que los decretos de estado de emergencia estarán sujetos, al igual que los demás decretos y normas, al control de constitucionalidad y legalidad prescritos en el ordenamiento jurídico. Cita el voto de la Sala Constitucional nro. 3410-92. Señala que, según indica tal voto, el desarrollo del contenido del artículo 180 de la Constitución Política tiene un claro objetivo que es la aplicación de un régimen de excepción, que no va aparejado con la ejecución de actos espurios y sin contenido que lo que reflejan es un abuso de poder y un menoscabo del sistema democrático. Reclama que el escenario de pandemia en el que estamos, es el que se ha alegado para proceder a aprobar en la Asamblea Legislativa el proyecto de ley que se convirtió en la Ley nro. 9838, cuyas características básicas son: a) tramitación acelerada, sin ningún tipo de publicidad, valoración, consulta institucional y discusión; b) coarta derechos y libertades fundamentales y esto lo hace de manera indefinida, pues obliga a las personas a no movilizarse mediante vehículos automotores de manera indeterminada sujetas al vaivén de un decreto ejecutivo; c) establece un incremento desproporcionado de las multas por restricción vehicular, que pasa de ₡22.383,18 a casi ₡111.000,00 en estos momentos, lo que implica un incremento de casi un 500% en relación con la multa anterior por incumplimiento a la restricción vehicular horaria en el GAM, contenida en la Ley de Tránsito.Agrega que el artículo 7 de nuestra Constitución Política establece que los convenios internacionales aprobados por la Asamblea Legislativa tendrán desde su promulgación autoridad superior a las leyes, y Costa Rica al ser parte de la Corte Interamericana de Derechos Humanos debe apegarse a su legislación, la cual estableció en la Convención Americana sobre Derechos Humanos, en su artículo 27, inciso 1, que la suspensión de garantías solamente puede darse “…siempre que no sean incompatibles con las demás obligaciones que les impone el derecho internacional…”, por consecuencia, la suspensión de utilizar los vehículos particulares en ciertas horas o días atenta contra la protección al derecho a la vida humana que constituye una clara contradicción e incumple con la obligación contraída con la Corte de Derechos Humanos promulgada en la Declaración Universal de Derechos Humanos en su artículo 3 y de la Constitución Política de Costa Rica en su artículo 21.Además, en la Declaración de la Corte Interamericana de Derechos Humanos se establece que “…Todas aquellas medidas que los Estados adopten para hacer frente a esta pandemia y puedan afectar o restringir el goce y ejercicio de derechos humanos deben ser limitadas temporalmente, legales, ajustadas a los objetivos definidos conforme a criterios científicos, razonables, estrictamente necesarias y proporcionales, y acordes con los demás requisitos desarrollados en el derecho interamericano de los derechos humanos…”. Criterios que no se cumplen, por lo que se viola el artículo 7 de la Constitución Política. Insiste que la medida de restricción vehicular sanitaria no le impide movilizarse del todo, sino solamente utilizar su vehículo. Al tener la necesidad de movilizase a ciertos lugares tendrá que hacerlo en transporte público, sea colectivo o modalidad taxi. Si se moviliza en un transporte colectivo, se estará viendo obligado a exponerse no solamente a decenas de personas durante la espera del transporte en un tiempo considerable en el cual incluso habrán otras personas esperando otro transporte o bien transitando por la vía, sino también a estar, al igual que en modalidad taxis, en un vehículo cerrado con gente que no conoce y con la cual no tiene relación, por lo que se le obliga incluso a romper las llamadas burbujas sociales; además, dentro del transporte no hay nadie realmente encargado de velar por el cumplimiento de las medidas sanitarias, ni de distanciamiento o limpieza de manos de las demás personas que también han ocupado el servicio.Si utilizara su vehículo particular saldría con su burbuja y con condiciones totalmente controladas de sanidad, lo que se le niega con la restricción vehicular, atentando así también contra el artículo 21 de la Constitución Política, poniendo en riesgo su vida e impidiéndole tomar las medidas correctas para protegerse. Alega que no existe algún criterio científico que justifique y compruebe que la utilización de los vehículos privados contribuye a la propagación del COVID-19. La medida de restricción vehicular sanitaria restringe el uso de algunos vehículos privados pero no la utilización de vehículos rentados, ni transporte público, por lo que la restricción no pretende restringir o evitar la movilidad de las personas, sino más bien promueve el rompimiento de burbujas sociales al utilizar vehículos de otros dueños y que a la vez son utilizados por muchas otras personas desconocidas, por lo que tampoco la medida cumple con el criterio de razonabilidad que pide la Corte de Derechos Humanos.Tampoco es razonable que se permita transitar en el día cuando hay más personas fuera de sus casas y en lugares públicos, pero se restrinja a transitar en horas de la noche en las que la afluencia de personas se reduce considerablemente por lo que las relaciones con personas posiblemente contagiadas se reduce. La hora de la restricción vehicular sanitaria corresponde al mismo horario de la restricción de comercios. El cierre de negocios sí impide la movilización de las personas, por lo que no es necesaria una medida que impida salir en los vehículos personales para impedir la movilidad, puesto que ya la medida de cierre de negocios lo logra, por lo que tampoco la medida cumple con el criterio de ser estrictamente necesaria como lo pide la Corte Interamericana de Derechos Humanos. Por lo anterior, solicita se acoja la presente acción de inconstitucionalidad.
  2. 2Por resolución de las 15:15 horas del 26 de agosto de 2021, se previno al accionante que “dentro del plazo de TRES DÍAS, contado a partir del día siguiente a la notificación de esta resolución y bajo apercibimiento de denegarle el trámite a la acción en caso de incumplimiento, deberá autenticar el escrito de interposición, así como aclarar cuál es la legitimación que ostenta para promover esta acción de inconstitucionalidad y de existir un asunto previo pendiente de resolver, en el que se haya invocado la inconstitucionalidad de la norma impugnada -con anterioridad a la interposición de la acción-, como medio razonable de amparar el derecho o interés que considera lesionado, deberá aportar certificación literal del escrito en el que se invocó la inconstitucionalidad de la norma en el asunto base y acreditar el estado procesal en que se encuentra tal asunto. Lo anterior, de conformidad a los artículos 75, 79 y 80 de la Ley de la Jurisdicción Constitucional”.
  3. 3Mediante escrito recibido en esta Sala el 31 de agosto de 2021, el accionante indica que la legitimación para presentar esta acción se base en el párrafo segundo del artículo 75 de la Ley de la Jurisdicción Constitucional. Aporta nuevamente escrito de interposición, con modificaciones, en el que se alega que interpone la acción en su “calidad de perjudicado por la restricción vehicular sanitaria al no poder hacer uso de mi vehículo personal durante ciertas horas y días”. También indica que la legitimación para la interposición de la presente acción de inconstitucionalidad se fundamenta en el párrafo segundo del artículo 75 de la Ley de la Jurisdicción Constitucional, “como defensa de un interés difuso”. Señala que la norma impugnada genera un “daño o interés difuso al restringir la libre circulación con sus vehículos particulares a los ciudadanos, imponiéndoles multas desproporcionales”.
  4. 4El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I. DE LOS REQUISITOS Y FORMALIDADES DE LA ACCIÓN DE INCONSTITUCIONALIDAD

Esta Sala ha señalado, de forma reiterada, que la acción de inconstitucionalidad es un proceso con determinadas formalidades, que, si no se reúnen, imposibilitan que este Tribunal se pronuncie sobre el fondo del asunto. El artículo 75 de la Ley de la Jurisdicción Constitucional regula la legitimación para interponer acciones de inconstitucionalidad y prevé situaciones distintas. En el párrafo primero se exige la existencia de un asunto pendiente de resolver, sea en sede judicial –incluyendo los recursos de hábeas corpus o de amparo- o en la administrativa –en el procedimiento de agotamiento de esta vía-, en el que se invoque la inconstitucionalidad de la norma cuestionada, como medio razonable de amparar el derecho o interés que se considera lesionado en el asunto principal. En los párrafos segundo y tercero se regula la acción directa –no se requiere del asunto base-, en los siguientes supuestos: a) cuando por la naturaleza del asunto no exista lesión individual y directa; b) se trate de la defensa de intereses difusos o que atañen a la colectividad en su conjunto; y c) cuando la acción sea promovida por el Procurador General de la República, el Contralor General de la República, el Fiscal General de la República y el Defensor de los Habitantes. En sentencia No. 04190-95 de las 11:33 horas del 28 de julio de 1995, este Tribunal precisó que la acción de inconstitucionalidad es:

“(…) un proceso de naturaleza incidental, y no de una acción directa o popular, con lo que se quiere decir que se requiere de la existencia de un asunto pendiente de resolver -sea ante los tribunales de justicia o en el procedimiento para agotar la vía administrativa- para poder acceder a la vía constitucional, pero de tal manera que, la acción constituya un medio razonable para amparar el derecho considerado lesionado en el asunto principal, de manera que lo resuelto por el Tribunal Constitucional repercuta positiva o negativamente en dicho proceso pendiente de resolver, por cuanto se manifiesta sobre la constitucionalidad de las normas que deberán ser aplicadas en dicho asunto; y únicamente por excepción es que la legislación permite el acceso directo a esta vía -presupuestos de los párrafos segundo y tercero del artículo 75 de la Ley de la Jurisdicción Constitucional…”.

En consonancia con lo anterior, esta Sala ha indicado que “el proceso de acción es, principalmente, de naturaleza incidental, por lo que se requiere de un asunto pendiente de resolver en vía administrativa –en el procedimiento administrativo de impugnación contra el acto final- o judicial, para que prospere la acción. De esta manera, solo en casos excepcionales que la ley establece, no será necesaria la existencia de ese requisito” (sentencia No. 2018-018560 de las 9:20 horas del 7 de noviembre de 2018). También ha aclarado que “los supuestos contenidos en el párrafo 2o. del artículo 75, constituyen una excepción a la regla establecida en el párrafo 1o. (vía incidental) que deben ser valorados cuidadosamente” (sentencia No. 2018-008413 de las 9:20 horas del 30 de mayo de 2018).

II. DE LA INADMISIBILIDAD DE LA PRESENTE ACCIÓN DE INCONSTITUCIONALIDAD

En respuesta a la prevención realizada por esta Sala, mediante resolución de las 15:15 horas del 26 de agosto de 2021, el accionante argumenta que su legitimación para interponer la presente acción de inconstitucionalidad se sustenta en el párrafo segundo del artículo 75 de la Ley de la Jurisdicción Constitucional, “como defensa de un interés difuso”. Señala, expresamente, que interpone la acción en su “calidad de perjudicado por la restricción vehicular sanitaria al no poder hacer uso de su vehículo personal durante ciertas horas y días”. También alega la existencia de “un daño o interés difuso al restringir la libre circulación con sus vehículos particulares a los ciudadanos, imponiéndoles multas desproporcionales”. Se constata, así, que la pretensión del fondo del accionante es cuestionar el establecimiento de la restricción a la circulación vehicular por razones de emergencia nacional, con la consecuente posibilidad que se le imponga una multa de tránsito a aquellos conductores concretos o individualizados que infrinjan tal restricción, en tanto alega el actor que esto le impide hacer uso de su vehículo particular.

De lo que se deriva que se pretende impugnar normativa que claramente es susceptible de aplicación individual. En cuyo caso, este Tribunal, por mayoría, ha estimado que cuando una norma es susceptible de aplicación individual, no cabe invocar los intereses difusos para admitir la acción. Así, recientemente, al conocer de un caso análogo, en que se pretendía impugnar la misma normativa que en el sub judice (en específico, el artículo 95 bis de la Ley nro 9078 y el Decreto Ejecutivo nro. 42.295-MOPT-S), con sustento, también, en una pretendida defensa de un interés difuso, esta Sala, mediante sentencia nro. 2021-09112 de las 13:16 horas del 5 de mayo de 2021, resolvió que:

“III.- SOBRE LA LEGITIMACIÓN DERIVADA DE LA DEFENSA DE INTERESES DIFUSOS Y COLECTIVOS. El accionante alega como segundo motivo de legitimación, la defensa de intereses difusos y colectivos. Sin embargo, este Tribunal, por mayoría, ha estimado que cuando una norma es susceptible de aplicación individual, no cabe invocar la defensa de intereses difusos o colectivos para admitir la acción. Así, por ejemplo, el voto No. 2018-18563 de las 9:20 horas del 7 de noviembre de 2018, esta Sala señaló:

“(…) la normativa reglamentaria cuestionada es susceptible de aplicación individual, incidiendo directamente en la esfera jurídica de personas singulares. Así que las personas accionantes pueden ser sujeto de actos que originen reclamaciones en la vía administrativa o jurisdiccional, no siendo factible alegar en estos casos, legitimación directa por la vía de la defensa de intereses difusos.” En el mismo sentido, en la sentencia 2020-4490 de las 9:20 horas del 4 de marzo de 2020, la Sala manifestó:

“… A partir de lo anterior, toda vez que las normas aquí impugnadas podrían originar el reclamo de personas fácilmente determinables e identificables dentro de un proceso penal, no puede estimarse que se esté en presencia de un supuesto de defensa de intereses difusos. De hecho, de admitirse la posibilidad de la accionante de plantear una acción de inconstitucionalidad en esta materia, en las condiciones pretendidas por ella, supondría reconocer la existencia de una acción popular, la cual, como lo ha indicado la Sala Constitucional en su reiterada jurisprudencia (véase la sentencia n°. 2016-000787 de las 9:05 horas del 20 de enero de 2016), no se adecua al marco de las competencias procesales que al efecto tiene este Tribunal Constitucional, en sus funciones de intérprete último y guardián de la Constitución. En consecuencia, al constatarse que la accionante no ha sustentado su legitimación en la existencia de un asunto pendiente de resolver en que se invocara la inconstitucionalidad de las normas aquí impugnadas ni, tampoco, tiene legitimación para ejercer la acción directa en defensa de intereses difusos, esta acción es inadmisible.” El criterio expuesto en los votos parcialmente transcritos es aplicable en el sub judice, pues es público y notorio que, en cuanto aplicabilidad del decreto ejecutivo, los actos que dicte la Administración Pública son susceptibles de ser discutidos en sede administrativa, en fase de agotamiento, o, en su defecto, ante los Tribunales ordinarios de la República, sea ante los Jueces de tránsito o de lo contencioso-administrativo.

Tome nota el accionante que, de conformidad con el artículo 75, párrafo primero, de la Ley de la Jurisdicción Constitucional, la regla que estableció el legislador es que para poseer legitimación con el fin de incoar una acción de inconstitucionalidad, debe existir un juicio base en el que se discuta la norma cuestionada y constituya un medio razonable para amparar el derecho que se debate en el citado juicio. Además de lo antes dicho, no es posible equipar un interés difuso a un interés colectivo, toda vez que el primero no es tan general que afecta a toda colectividad o tan específico que afecta solo a una persona, pues se trata de un interés que afecta a un grupo que no está formalmente organizado; mientras que el segundo, este Tribunal lo ha equiparado a un interés corporativo, y solo en casos muy excepcionales, que afectan a toda la colectividad (véase la sentencia N.° 8239-01, en que el concepto de intereses que atañen a la colectividad se asocia con la defensa de los bienes en los cuales los sujetos son detentadores de la soberanía.

“No se trata por ende de que cualquier persona pueda acudir a la Sala Constitucional en tutela de cualesquiera intereses (acción popular), sino que todo individuo puede actuar en defensa de aquellos bienes que afectan a todas la colectividad nacional”); empero esta tesis no ha sido dominante en la jurisprudencia de esta Sala en los últimos años.” Consideraciones aplicables caso en estudio, por lo que la presente acción es inadmisible y procede su rechazo de plano, como así se dispone.

III. NOTA DE LA MAGISTRADA GARRO VARGAS

En la sentencia n.°2021-09112, invocada por la mayoría para rechazar la presente acción, consigné una nota separada en la que perfilo mi interpretación respecto de la admisibilidad de las acciones en las que se invoca un supuesto interés difuso que, más bien, se debe encuadrar como un caso en el que claramente puede existir un asunto pendiente de resolución como mecanismo incidental para admitir la legitimación de la acción de inconstitucionalidad. En dicha sentencia realicé las siguientes consideraciones:

“En este asunto he concurrido con mi voto en declarar la inadmisibilidad de la acción de inconstitucionalidad. Pero he optado por consignar una nota separada con la que pretendo perfilar mi criterio en relación con la legitimación y la admisibilidad de este proceso en concreto. En ese sentido, considero necesario precisar que lo resuelto por la mayoría no significa que se pueda admitir —como regla general— que, cuando pueda existir un reclamo por una violación individual y directa, no procede per se afirmar que no corresponde tutelar paralelamente la protección de los intereses difusos. Es decir, habrá casos en que en atención a la situación jurídica sustancial afectada podría configurarse ambos supuestos. Distinto es el caso en que razonablemente se pueda desprender que, si bien se alega un interés difuso, lo que subyace es una clara utilidad personal e individual de otra naturaleza o, incluso, otro derecho subjetivo que no engloba paralelamente la protección de los intereses difusos.

Asimismo, tampoco corresponde alegar la defensa de los intereses difusos de forma tan amplia y abstracta que se confunda con una especie de acción popular, lo cual ha sido vedado en los precedentes de esta Sala. Por ejemplo, en la sentencia n.°2016-5589 se cuestionó una omisión legislativa de establecer, en la Ley General de Ferrocarriles, medidas adecuadas de seguridad para los ciudadanos peatones y conductores. En lo conducente, la Sala resolvió lo siguiente:

“no puede estimarse que en la especie se esté en presencia de un supuesto de intereses difusos. Aunque el accionante sostenga que la omisión acusada atenta en contra de la seguridad de todos los “ ciudadanos-peatones” y “ ciudadanos-conductores”, lo cierto es que no puede estimarse que se esté ante un grupo o categoría que reúna las particularidades descritas en los precedentes parcialmente transcritos y, por el contrario, se está en presencia de un presunto colectivo tan dilatado, impreciso y difuminado que, simplemente, se identifica con la comunidad nacional como un todo. Debe reiterarse, por esto, lo resuelto por esta Sala en el sentido que el interés difuso no debe ser tan diluido que se confunda con la colectividad nacional, es decir, “no puede llegar a ser tan amplio y genérico que se confunda con el reconocido a todos los miembros de la sociedad de velar por la legalidad constitucional” (ver sentencia No. 0360-99, supra citada).

En efecto, de admitirse la posibilidad del actor de plantear una acción de inconstitucionalidad en esta materia, en las condiciones pretendidas por este, supondría –en definitiva- reconocer la existencia de una acción popular, la cual, como lo ha indicado la Sala Constitucional en su reiterada jurisprudencia (ver sentencia No. 2016-000787 de las 9:05 hrs. del 20 de enero de 2016), no se adecua al marco de las competencias procesales que al efecto tiene este Tribunal Constitucional, en sus funciones de intérprete último y guardián de la Constitución.”(Lo resaltado no corresponde al original).

En definitiva, no parece que resulte válido utilizar “el ropaje” de un interés difuso para garantizar la admisibilidad de una acción de inconstitucionalidad, cuando se puede corroborar que lo que se procura es el resguardo de otro tipo de derechos o intereses que bien podrían ser tutelados en una acción de inconstitucionalidad, pero a través del supuesto contemplado en el art. 75, párrafo 1°, de la Ley de la Jurisdicción Constitucional.” Apreciaciones que igualmente estimo resultan de aplicación al caso concreto en el que no se invocó ningún asunto previo como legitimación para cuestionar la restricción a la circulación vehicular por vías terrestres.

IV. RAZONES DIFERENTES DEL MAGISTRADO RUEDA LEAL

Intereses difusos son aquellos cuya titularidad pertenece a una comunidad de personas que no se encuentra organizada formalmente, pero cuya unión se produce a partir de una necesidad social, una característica física, el origen étnico, una orientación personal o ideológica, el consumo de cierto producto, etc. El interés, en estos casos, se encuentra difuminado o diluido entre una pluralidad no identificada de sujetos; en este sentido, a la luz del párrafo 2°, del ordinal 75 de la Ley de la Jurisdicción Constitucional, la impugnación por inconstitucional con base en este tipo de interés inexorablemente debe estar referida a esa pluralidad, en los términos expuestos. Esta Sala ha enumerado diversos bienes y derechos constitucionales, en relación con los cuales se puede argüir un interés difuso, verbigracia, el ambiente sano y ecológicamente equilibrado, el patrimonio cultural, la integridad territorial del país, el buen manejo del gasto público, los derechos del consumidor, entre otros.

Al respecto, deben efectuarse las siguientes precisiones. Por un lado, los mencionados bienes y derechos trascienden la esfera individual o corporativa, porque incumben a una generalidad; así, un daño ambiental no afecta apenas a los vecinos de una región, sino que lesiona o pone en grave riesgo el derecho a un ambiente sano y ecológicamente equilibrado de todo el país, incluso, según la envergadura, de la humanidad como tal. De igual forma, la defensa del buen manejo que se haga de los fondos públicos autorizados en el Presupuesto de la República refleja un interés de todos los habitantes de Costa Rica, no solo de un grupo específico.

La distinción no es sencilla; empero, ciertamente se debe buscar un punto de equilibrio, de modo que los intereses difusos en el sentido expuesto hallen cobijo constitucional, sin que se llegue a una extensión tal del concepto, que por esa vía se configure una acción popular en los diversos procesos de constitucionalidad, con excepción de lo dispuesto en el artículo 105 de la Ley de Biodiversidad. Para tales efectos, el juez constitucional debe valorar caso por caso, a fin de definir si el interés en un determinado asunto reviste tal grado de trascendencia y la problemática acusada difumina sus perjuicios con semejante cobertura, como para justificar que se esté ante un interés que atañe a la comunidad en general.

En cuanto a lo antedicho, se debe observar que el mero hecho de que una norma o directriz cuestionada, cuando ello es objeto de un proceso de acción de constitucionalidad, sea susceptible de aplicación individual e incidir de forma directa en la esfera jurídica de personas singulares e identificables, no significa el descarte de un interés difuso, toda vez que hay situaciones en las que al lado del último confluye uno particular. Por ejemplo, piénsese en una disposición que eximiera de requerimientos de preservación una obra en una estructura declarada patrimonio cultural; en tal asunto, esa medida afectaría intereses difusos, toda vez que sus consecuencias perniciosas se disiparían a través de toda una comunidad, lo que no obsta para que, igual y simultáneamente, un individuo, asiduo visitante de tal sitio, se viera perjudicado en lo personal y pudiera entablar un reclamo. Ergo, la existencia de un interés difuso no excluye que un sujeto pueda experimentar una lesión en sus intereses particulares, aun de mayor calado que en la generalidad de personas.

A mayor abundamiento, una aplicación del principio pro actione también lleva a interpretar las normas de manera favorable para la tutela de los derechos fundamentales y la protección de la supremacía constitucional. Por consiguiente, la legitimación por intereses difusos deviene procedente independientemente de que la disposición o el acto impugnado fuese susceptible de aplicación individual. En el caso de marras, sin embargo, no observo la existencia de algunos de los intereses difusos desarrollados por la jurisprudencia y, por ese motivo, rechazo tal legitimación.

V. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se rechaza de plano la acción. La Magistrada Garro Vargas consigna nota. El Magistrado Rueda Leal da razones diferentes.
