RECITALS:

1. 1By written submission received in the Chamber's Secretariat at By written submission added to the Electronic Case Management System of this Office, the petitioner alleges non-compliance with the ruling issued by this Chamber in judgment number 2018001540 of 09:15 hours on February 2, 2018, in which the following was ordered: "The petition is partially granted, solely with respect to the Municipality of Curridabat, for failure to comply with sanitary order (orden sanitaria) Nº 042-10 of August 18, 2010, as set forth in Voto 2010-020634 of fourteen hours and one minute on December fourteenth, two thousand ten. Alicia Borja Rodríguez, Mayor of Curridabat, or whoever may be holding that office in her place, is ordered to take all necessary measures to immediately comply with sanitary order Nº 042-10 of August 18, 2010, and with the provisions of Voto 2010-020634 of this Chamber of fourteen hours and one minute on December fourteenth, two thousand ten, and to report thereon to this Chamber.(…)". The aforementioned judgment was subsequently reiterated by Judgment No. 2019-022417 of nine hours and thirty minutes on November thirteenth, two thousand nineteen, which ordered: "Alicia Borja Rodríguez, Mayor of the Municipality of Curridabat, or whoever may be holding that office in her place, is hereby reminded of the obligation to comply with what was ordered by this Chamber in resolution No. 2018001540 of 9:15 hours on February 2, 2018 (…)". Furthermore, by resolution No. 2021-009957 of nine hours and fifteen minutes on May twenty-first, two thousand twenty-one, it was again stated: "Jimmy Cruz Jiménez, Mayor of the Municipality of Curridabat, or whoever may be holding that office in his place, is hereby reminded of the obligation to comply with what was ordered by this Chamber in resolutions No. 2018-001540 of 9:15 hours on February 2, 2018, in which it was stated: '…Alicia Borja Rodríguez, Mayor of Curridabat, or whoever may be holding that office in her place, is ordered to take all necessary measures to immediately comply with sanitary order Nº 042-10 of August 18, 2010, and with the provisions of Voto 2010-020634 of this Chamber of fourteen hours and one minute on December fourteenth, two thousand ten, and to report thereon to this Chamber…'".
2. 2The most recent reiteration judgment, No. 2021-009957 of nine hours and fifteen minutes on May twenty-first, two thousand twenty-one, was notified to the Mayor of Curridabat on May 25, 2021, via email address ...01, the means indicated by the respondent authority for receiving notifications.
3. 3By written submission added to the Electronic Case Management System of this Office on August 16, 2021, María del Mar Saborío Víquez, Coordinator of the Integral Risk Management Department (Departamento de Gestión Integral del Riesgo) of the Municipality of Curridabat, filed a sworn report. She states that progress has been made in implementing the required actions in response to the reported needs. She adds that on May 20, 2021, resolution No. 0778-2021-SETENA was obtained for the slope stabilization works design project at the Tulipanes residential development (urbanización Tulipanes), Curridabat, by which environmental viability (viabilidad ambiental) for the project was granted. She notes that, immediately after receiving environmental viability, the file was submitted to the Directorate of Water Resources (Dirección de Aguas) of MINAE, and a meeting was also requested with the Director to convey the urgency of obtaining said permit. She further states that on June 14, 2021, Work Resolution in Waterway DA-0906-2021 was received, granting the permit for works in a public-domain waterway (cauce de dominio público). She concludes by noting that the administrative contracting process for the construction of the works is being carried out by the Road Management Directorate (Dirección de Gestión Vial).
4. 4By written submission added to the Electronic Case Management System of this Office, Randal Rodríguez Araya, Director of the Road Management Directorate of the Municipality of Curridabat, filed a sworn report. He states that, with the necessary environmental permits in hand, the process was initiated through the issuance of goods and services order No. 24440 and the corresponding justification memorandum No. MC-GV-0406-06-2021, drafting the project's particular terms and conditions, which are currently under final review by the municipal procurement office for submission of the contracting request on the Integrated Public Procurement System (Sistema Integrado de Compras Públicas, SICOP) platform. He alleges that "…In light of the foregoing, the institutional process to acquire the engineering and construction services required to carry out the works through the Road Management Directorate has technically been initiated…".
5. 5By written submission added to the Electronic Case Management System of this Office, the petitioner replied to the reports filed by the respondent authority.
6. 6The legal requirements applicable to these proceedings have been duly observed.

SOLE GROUND. — On the motion filed. The petitioning party once again brings a motion for contempt (desobediencia) of what was ordered by this Chamber in judgment number 2018001540 of 09:15 hours on February 2, 2018, in which the following was ordered: "The petition is partially granted, solely with respect to the Municipality of Curridabat, for failure to comply with sanitary order Nº 042-10 of August 18, 2010, as set forth in Voto 2010-020634 of fourteen hours and one minute on December fourteenth, two thousand ten. Alicia Borja Rodríguez, Mayor of Curridabat, or whoever may be holding that office in her place, is ordered to take all necessary measures to immediately comply with sanitary order Nº 042-10 of August 18, 2010, and with the provisions of Voto 2010-020634 of this Chamber of fourteen hours and one minute on December fourteenth, two thousand ten, and to report thereon to this Chamber.

(…)". Subsequently, by judgment No. 2019-022417 of nine hours and thirty minutes on November thirteenth, two thousand nineteen, the cited judgment was reiterated: "Alicia Borja Rodríguez, Mayor of the Municipality of Curridabat, or whoever may be holding that office in her place, is hereby reminded of the obligation to comply with what was ordered by this Chamber in resolution No. 2018001540 of 9:15 hours on February 2, 2018 (…)". Furthermore, by resolution No. 2021-009957 of nine hours and fifteen minutes on May twenty-first, two thousand twenty-one, the judgment was again reiterated: "Jimmy Cruz Jiménez, Mayor of the Municipality of Curridabat, or whoever may be holding that office in his place, is hereby reminded of the obligation to comply with what was ordered by this Chamber in resolutions No. 2018-001540 of 9:15 hours on February 2, 2018, in which it was stated: '…Alicia Borja Rodríguez, Mayor of Curridabat, or whoever may be holding that office in her place, is ordered to take all necessary measures to immediately comply with sanitary order Nº 042-10 of August 18, 2010, and with the provisions of Voto 2010-020634 of this Chamber of fourteen hours and one minute on December fourteenth, two thousand ten, and to report thereon to this Chamber…'".

In this regard, the Coordinator of the Integral Risk Management Department of the Municipality of Curridabat indicated that project viability has already been obtained and that the administrative contracting process for the construction of the works is being carried out by the Road Management Directorate. For its part, the Director of the Road Management Directorate of the Municipality of Curridabat indicated that, with the necessary environmental permits in hand, the process was initiated through the issuance of goods and services order No. 24440 and the corresponding justification memorandum No. MC-GV-0406-06-2021, drafting the project's particular terms and conditions, which are currently under final review by the municipal procurement office for submission of the contracting request on the SICOP platform. He alleges that "…In light of the foregoing, the institutional process to acquire the engineering and construction services required to carry out the works through the Road Management Directorate has technically been initiated…".

However, such considerations are not accepted by this Chamber, as it is observed that the Municipality of Curridabat has repeatedly failed to comply with what was ordered by this Court in judgment 2018001540 of 09:15 hours on February 2, 2018, which ordered: "Alicia Borja Rodríguez, Mayor of Curridabat, or whoever may be holding that office in her place, is ordered to take all necessary measures to immediately comply with sanitary order Nº 042-10 of August 18, 2010, and with the provisions of Voto 2010-020634 of this Chamber of fourteen hours and one minute on December fourteenth, two thousand ten, and to report thereon to this Chamber. (…)". In addition to the foregoing, it must be noted that, even as of the date on which the aforementioned reports were filed — signed by María del Mar Saborío Víquez, Coordinator of the Integral Risk Management Department, and Randal Rodríguez Araya, Director of the Road Management Directorate, both of the Municipality of Curridabat — compliance has not been achieved with what was ordered in judgment 2018001540 of 09:15 hours on February 2, 2018, which was personally notified to Curridabat Mayor Alicia Borja Rodríguez as far back as February 9, 2018, meaning that three years and five months have elapsed without effective compliance with the judgment.

In light of the foregoing, the provisions of Article 71 of the Ley de la Jurisdicción Constitucional must be applied, and the referral of certified case documents (testimoniar piezas) to the Public Prosecutor's Office (Ministerio Público) must be ordered so that it may investigate this non-compliance.

THEREFORE:

It is ordered that certified copies of the relevant case documents (testimoniar piezas) be referred to the Office of the Public Prosecutor (Ministerio Público) for investigation of non-compliance with the ruling issued by this Chamber in judgment number 2018001540 of 09:15 hours on February 2, 2018.

RESULTANDO:

1. 1Por escrito recibido en la Secretaría de la Sala a las Por escrito agregado al Sistema Electrónico de Gestión de este Despacho, el recurrente acusa incumplimiento de lo resuelto por esta Sala en la sentencia número 2018001540 de las 09:15 horas del 02 de febrero de 2018, toda vez que en esa sentencia se dispuso lo siguiente: "Se declara parcialmente con lugar el recurso, únicamente en cuanto se refiere a la Municipalidad de Curridabat, por el incumplimiento de la orden sanitaria Nº 042-10 de 18 de agosto de 2010, según lo dispuesto, en el Voto 2010-020634 de las catorce horas y uno minutos del catorce de diciembre del dos mil diez. Se ordena a Alicia Borja Rodríguez, Alcaldesa de Curridabat, o a quien en su lugar ejerza ese cargo, que disponga lo necesario para que de manera inmediata, se cumpla la orden sanitaria Nº 042-10 de 18 de agosto de 2010, y lo dispuesto, en el Voto de esta Sala número 2010-020634 de las catorce horas y uno minutos del catorce de diciembre del dos mil diez, sobre lo cual deberá informar a esta Sala.(…)". La citada sentencia fue reiterada por medio de Sentencia No. 2019-022417 de las nueve horas con treinta minutos del trece de noviembre de dos mil diecinueve, en la cual se dispuso: "Se le reitera a Alicia Borja Rodríguez, Alcaldesa de la Municipalidad de Curridabat, o a quien en su lugar ejerza ese cargo, que proceda al cumplimiento de lo dispuesto por esta Sala en la resolución No. 2018001540 de las 9:15 horas del 02 de febrero de 2018 (…)". A su vez, nuevamente por resolución No. 2021-009957 de las nueve horas quince minutos del veintiuno de mayo de dos mil veintiuno, en donde se indicó: "Se le reitera a Jimmy Cruz Jiménez, Alcalde de la Municipalidad de Curridabat, o a quien en su lugar ejerza ese cargo, que proceda al cumplimiento de lo dispuesto por esta Sala en las resoluciones No. 2018-001540 de las 9:15 horas del 02 de febrero de 2018, en la cual se indicó: "…Se ordena a Alicia Borja Rodríguez, Alcaldesa de Curridabat, o a quien en su lugar ejerza ese cargo, que disponga lo necesario para que de manera inmediata, se cumpla la orden sanitaria Nº 042-10 de 18 de agosto de 2010, y lo dispuesto, en el Voto de esta Sala número 2010-020634 de las catorce horas y uno minutos del catorce de diciembre del dos mil diez, sobre lo cual deberá informar a esta Sala…".
2. 2La última sentencia de reiteración No. 2021-009957 de las nueve horas quince minutos del veintiuno de mayo de dos mil veintiuno, le fue notificada al Alcalde de Curridabat el 25 de mayo de 2021, mediante el correo electrónico ...01, medio indicado por la autoridad recurrida para recibir notificaciones.
3. 3Mediante escrito agregado al Sistema Electrónico de Gestión de este Despacho el 16 de agosto de 2021, rinde informe bajo fe de juramento, María del Mar Saborío Víquez, Coordinadora del Departamento de Gestión Integral del Riesgo de la Municipalidad de Curridabat. Indica que, se han realizado avances en la ejecución de las acciones frente a las necesidades denunciadas. Agrega que, el 20 de mayo de 2021, se obtuvo la resolución No. 0778-2021-SETENA Proyecto de diseño de obras para la estabilización de talud en la urbanización Tulipanes, Curridabat, mediante el cual, se otorgó la viabilidad para el proyecto. Señala que, inmediatamente, posterior a recibir la viabilidad ambiental se procedió a ingresar el expediente en la Dirección de Aguas del MINAE y además se solicitó reunión con el Director para exponerle el sentido de urgencia de dicho permiso. Acota que, el 14 de junio de 2021, se recibió la Resolución de Obra en Cauce DA-0906-2021, otorgando el permiso de obra en cauce de dominio público. Finaliza diciendo que, el proceso de contratación administrativa para la construcción de la obra, es llevado a cabo por la Dirección de Gestión Vial.
4. 4Mediante escrito agregado al Sistema Electrónico de Gestión de este Despacho, rinde informe bajo fe de juramento, Randal Rodríguez Araya, Director de Gestión Vial de la Municipalidad de Curridabat. Indica que, contando con las licencias ambientales necesarias, se dio inicio al proceso mediante la emisión de la orden de bienes y servicios No. 24440 y su correspondiente oficio de justificación No. MC-GV-0406-06-2021, elaborando el pliego de condiciones particulares del proyecto y se encuentran en etapa de revisión final por parte de la proveeduría municipal para la solicitud de contratación en la plataforma del sistema integrado de Compras Públicas (SICOP). Alega que "…En vista de lo anterior técnicamente se ha iniciado el proceso institucional para adquirir los servicios de ingeniería y construcción para ejecutar la obra por parte de la Dirección de Gestión Vial…".
5. 5Mediante escrito agregado al Sistema Electrónico de Gestión de este Despacho, el recurrente replica los informes rendidos por parte de la autoridad recurrida.
6. 6En los procedimientos seguidos se han observado las prescripciones legales.

Redacta la Magistrada Sánchez Navarro; y,

CONSIDERANDO:

ÚNICO.- Sobre la gestión planteada. La parte recurrente una vez más, plantea una gestión de desobediencia a lo ordenado por esta Sala en la sentencia número 2018001540 de las 09:15 horas del 02 de febrero de 2018, toda vez que en esa sentencia se dispuso lo siguiente: "Se declara parcialmente con lugar el recurso, únicamente en cuanto se refiere a la Municipalidad de Curridabat, por el incumplimiento de la orden sanitaria Nº 042-10 de 18 de agosto de 2010, según lo dispuesto, en el Voto 2010-020634 de las catorce horas y uno minutos del catorce de diciembre del dos mil diez. Se ordena a Alicia Borja Rodríguez, Alcaldesa de Curridabat, o a quien en su lugar ejerza ese cargo, que disponga lo necesario para que de manera inmediata, se cumpla la orden sanitaria Nº 042-10 de 18 de agosto de 2010, y lo dispuesto, en el Voto de esta Sala número 2010-020634 de las catorce horas y uno minutos del catorce de diciembre del dos mil diez, sobre lo cual deberá informar a esta Sala.

(…)". Posteriormente, mediante la sentencia No. 2019-022417 de las nueve horas con treinta minutos del trece de noviembre de dos mil diecinueve, se reiteró la sentencia de cita "Se le reitera a Alicia Borja Rodríguez, Alcaldesa de la Municipalidad de Curridabat, o a quien en su lugar ejerza ese cargo, que proceda al cumplimiento de lo dispuesto por esta Sala en la resolución No. 2018001540 de las 9:15 horas del 02 de febrero de 2018 (…)". A su vez, nuevamente por resolución No. 2021-009957 de las nueve horas quince minutos del veintiuno de mayo de dos mil veintiuno, se reiteró la sentencia: "Se le reitera a Jimmy Cruz Jiménez, Alcalde de la Municipalidad de Curridabat, o a quien en su lugar ejerza ese cargo, que proceda al cumplimiento de lo dispuesto por esta Sala en las resoluciones No. 2018-001540 de las 9:15 horas del 02 de febrero de 2018, en la cual se indicó: "…Se ordena a Alicia Borja Rodríguez, Alcaldesa de Curridabat, o a quien en su lugar ejerza ese cargo, que disponga lo necesario para que de manera inmediata, se cumpla la orden sanitaria Nº 042-10 de 18 de agosto de 2010, y lo dispuesto, en el Voto de esta Sala número 2010-020634 de las catorce horas y uno minutos del catorce de diciembre del dos mil diez, sobre lo cual deberá informar a esta Sala…".

Al respecto, la Coordinadora del Departamento de Gestión Integral del Riesgo de la Municipalidad de Curridabat, indicó que ya se cuenta con la viabilidad del proyecto y que el proceso de contratación administrativa para la construcción de la Obra, es llevado a cabo por la Dirección de Gestión Vial. Por su parte, el Director de Gestión Vial de la Municipalidad de Curridabat, indicó que, contando con las licencias ambientales necesarias, se dio inicio al proceso mediante la emisión de la orden de bienes y servicios No. 24440 y su correspondiente oficio de justificación No. MC-GV-0406-06-2021, elaborando el pliego de condiciones particulares del proyecto y se encuentran en etapa de revisión final por parte de la proveeduría municipal para la solicitud de contratación en la plataforma del sistema integrado de Compras Públicas (SICOP). Alega que "…En vista de lo anterior técnicamente se ha iniciado el proceso institucional para adquirir los servicios de ingeniería y construcción para ejecutar la obra por parte de la Dirección de Gestión Vial…".

No obstante, tales consideraciones no son de recibo para esta Sala, pues se observa que, la municipalidad de Curridabat ha incurrido en reiteradas ocasiones en desobediencia a lo ordenado por este Tribunal en la sentencia 2018001540 de las 09:15 horas del 02 de febrero de 2018, que dispuso: "Se ordena a Alicia Borja Rodríguez, Alcaldesa de Curridabat, o a quien en su lugar ejerza ese cargo, que disponga lo necesario para que de manera inmediata, se cumpla la orden sanitaria Nº 042-10 de 18 de agosto de 2010, y lo dispuesto, en el Voto de esta Sala número 2010-020634 de las catorce horas y uno minutos del catorce de diciembre del dos mil diez, sobre lo cual deberá informar a esta Sala. (…)". Aunado a lo anterior, debe notarse que, incluso a la fecha de rendición de los informes referidos, suscritos por María del Mar Saborío Víquez, Coordinadora del Departamento de Gestión Integral del Riesgo y Randal Rodríguez Araya, Director de Gestión Vial, ambos de la Municipalidad de Curridabat, no se ha dado cumplimiento a lo ordenado en la sentencia 2018001540 de las 09:15 horas del 02 de febrero de 2018, la cual, fue notificada a la Alcaldesa de Curridabat Alicia Borja Rodríguez, en forma personal desde el 09 de febrero de 2018, es decir, que han transcurrido tres años y 5 meses, sin un cumplimiento efectivo de la sentencia.

En virtud de lo expuesto, se debe aplicar lo estatuido en el artículo 71 de la Ley de la Jurisdicción Constitucional y ordenar testimoniar piezas al Ministerio Público para que investigue este incumplimiento.

POR TANTO:

Se ordena testimoniar piezas al Ministerio Público para que investigue el incumplimiento de lo resuelto por esta Sala en la sentencia número 2018001540 de las 09:15 horas del 02 de febrero de 2018.
