Document Review Decision No. 2021019810 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at ten hours and six minutes on September third, two thousand twenty-one.

Amparo proceeding (recurso de amparo) processed under case file N° 21-015543- 0007-CO, filed by Nombre01, holder of identity card CED02, against the Instituto Costarricense de Acueductos y Alcantarillados.

RECITALS:

  1. 1In a brief received by the Chamber’s Secretariat at 7:42 a.m. on August 10, 2021, the petitioner filed an amparo proceeding against the Instituto Costarricense de Acueductos y Alcantarillados. The petitioner states that he owns the property registered under real-property folio number , located in Liberia, Guanacaste, Dirección01, Dirección02. He states that the residential development has the approvals and permits issued by the Municipalidad de Liberia and the Instituto Costarricense de Acueductos y Alcantarillados, and therefore residential homes have been built. There is a sanitary sewer system (alcantarillado sanitario) that conveys the wastewater (aguas residuales) through pipes. The homes do not have septic tanks (tanques sépticos) because the soil type does not allow them to function properly. He adds that the sanitary sewer service regularly collapses and sewage (aguas negras) is discharged into the río Liberia without having passed through the treatment lagoons (lagunas de tratamiento).He complains that the Institute does not maintain the sanitary sewer system or the pumps, even though fees are charged for that service. He states that, in response to this situation, a group of residents undertook to pay the sanitary sewer system’s maintenance costs in order to avoid endangering the community’s health and to guarantee the right to a healthy and ecologically balanced environment. He challenges the respondents’ failure to maintain the treatment plant (planta de tratamiento) and prevent sewage from reaching the río Liberia, which is a tributary of the río Tempisque, one of the most important rivers in his country. He explains that he has submitted several requests to the Institute concerning the pumping station (planta de rebombeo) at Residencial Camino de Luna and the lack of maintenance. He adds that the respondent authorities are fully aware of the problems affecting the residential development’s treatment plant and sanitary sewer system. He considers that the facts described violate his fundamental rights.
  2. 2By order issued at 1:08 p.m. on August 11, 2021, the Chamber ordered the petitioner to provide a complete and legible copy, bearing a receipt stamp or the corresponding proof of transmission by email, of the complaints filed with the respondent authorities concerning the facts set forth in the petition initiating this proceeding.
  3. 3On August 11, 2021, the petitioner sent the Chamber copies of two emails exchanged between Engineer Araya García of the Instituto Costarricense de Acueductos y Alcantarillados and Fabián Sánchez León of the company FASAYCO S.A., dated September 22, 2010 and October 24, 2010.
  4. 4By order issued at 9:18 a.m. on August 19, 2021, this amparo proceeding was admitted for processing, and the Deputy Manager and the Head of the Collection and Treatment Strategic Business Unit (UEN Recolección y Tratamiento) of the Peripheral Systems Management Office, as well as the Head of the Liberia Cantonal Office of the Instituto Costarricense de Acueductos y Alcantarillados, were granted a hearing.
  5. 5In a brief filed on August 24, 2021, Natalie Montiel Ulloa, Deputy Manager of Peripheral Systems; Álvaro Araya García, Director of UEN RyT Sistemas Periféricos; and Wander Cubero Hurtado, Head of the Liberia Cantonal Office of the Instituto Costarricense de Acueductos y Alcantarillados, report that, when the Institute granted confirmation of service availability prior to construction of the Urbanización, it informed the developer that, in order to enable wastewater collection and treatment, the developer was required to carry out works conforming to AyA’s technical standards (sanitary sewer networks, a pumping station, and, if necessary, a wastewater treatment plant) and, once completed, formally transfer them to the Institute for acceptance, operation, and maintenance. It was expressly indicated that the issuance of that “sanitary sewer availability” document did not under any circumstances imply approval of the project, much less of the works, since those works required review to verify compliance with the technical standards.Nevertheless, the private party never fulfilled that obligation; instead, it built the works outside the applicable regulations and, without authorization from the Institute, connected the residential development’s wastewater system to one of the area’s sewer mains (colectores). The sanitary sewer system must collect by gravity the wastewater from a residential development, condominium, or urban development (urbanización). Likewise, under the principle of continuity (principio de continuidad), the networks begin with a small diameter, with water being added until it reaches an “inflow” pipe of considerable diameter. When the project known as “Camino Luna” was conceived, in order to provide sewer service to an urban development where the soil’s low infiltration rate did not permit the use of septic tanks, the project designer was required to install a Wastewater Pumping Station (Estación de Bombeo de Aguas Residuales, EBAR) if the city system (the lagoons) had treatment capacity, or to build a Wastewater Treatment Plant (Planta de Tratamiento de Aguas Residuales, PTAR) if such permission was denied.Installing a Wastewater Pumping Station entails a series of requirements, the first of which is respecting the river protection area (área de protección), which has not been done in this case. The tank mentioned by Mr. Nombre01 is not a tank; it is a wastewater pumping cistern (cisterna de bombeo), which forms part of a group of structures that were not accepted at the time because they failed to meet the institution’s requirements. It was therefore concluded that this urban development was apparently connected to the Ciudad de Liberia sanitation system (sistema de saneamiento) irregularly and without formal authorization from AyA. In 2009, during the process of replacing the sanitary sewer pipeline near the urban development—part of the maintenance AyA performs on infrastructure under its administration and operation—it was discovered that the development was interconnected with the sanitary sewer network—official letter N° GSPRCH-CL-2021-O0975-.Once what appeared to constitute an irregular connection to the Liberia sanitary sewer system had been identified, the applicable provisions of the Autoridad Reguladora de los Servicios Públicos (ARESEP) were assessed regarding the impossibility of suspending sanitary sewer service, as well as the public-health risk that any suspension or disconnection of that service would pose, given that the project was designed and built on the basis of a sanitary sewer solution rather than septic tanks. The officials responsible at the time decided to retain and improve the urban development’s existing connection to the collection networks owned by AyA and to charge the corresponding fees for collecting the wastewater generated by its homes, with the understanding that AyA has neither approved nor accepted the sewer system within the Urbanización and that its operation and maintenance—within the urban development—remain entirely the responsibility of the interested parties and/or project developers until the applicable requirements and regulations are met.If an event occurs in Liberia that could endanger public health due to a wastewater overflow, the Cantonal Unit is capable of responding in accordance with established institutional procedures, for which purpose users have access to the communication channels officially established by AyA. The Institute performs preventive maintenance on its sewer mains, including the one serving Residencial Camino Luna. It is neither feasible, lawful, nor financially possible for AyA to assume the costs of works that are the developer’s responsibility or to assume responsibilities falling within the jurisdiction of other entities, in this case the local government. The Institute cannot depart from its own standards or decline to apply them in this particular case, in flagrant violation of the principle of constitutional and administrative legality (principio de legalidad constitucional y administrativa), because the works comprising the sanitation system, in this case within the residential development, must satisfy the established technical requirements.
  6. 6The statutory requirements have been observed in the proceedings conducted.

Justice Salazar Alvarado authored the decision; and,

CONSIDERING:

I. SUBJECT MATTER OF THE PROCEEDING

The petitioner alleges that his fundamental rights have been infringed for the following reasons: 1) The sanitary sewer system at Residencial Camino Luna, Liberia, Guanacaste, regularly collapses, causing sewage to be discharged into the río Liberia. 2) The authorities of the Instituto Costarricense de Acueductos y Alcantarillados do not maintain the sanitary sewer system, despite payment for the service. 3) He has submitted multiple requests concerning the pumping station, and to date they have not been answered.

II. PROVEN FACTS

The following facts are deemed duly established and relevant to the determination of this matter, either because they have been substantiated or because the respondent failed to address them as required by the initial order:

  • a)Urban-development projects requiring sanitary sewer availability must comply with the technical and legal standards necessary for approval by the Instituto Costarricense de Acueductos y Alcantarillado. (See documentation).
  • b)By official letter CH-IR-2002-344 of May 10, 2002, the Office of the Head of Región Chorotega notified the developers of the Urbanización Camino Luna project of the availability of drinking water. Regarding the sanitary sewer system, they were advised that approval required construction of the following: a sanitary sewer network, pumping station, stormwater collection network (red de recolección pluvial), and drinking-water pipeline (cañería potable). (See documentation).
  • c)The Urbanización Camino Luna Project, located in the district of Liberia, province of Guanacaste, cadastral plan (plano catastro) G-752513-2001, has approved construction plans (official letter URB. 2003-0108 dated May 14, 2003).
  • d)The Urbanización Camino Luna Project does not have sanitary sewer availability because of its failure to comply with infrastructure requirements, technical regulations, and institutional procedures. (See documentation).
  • e)The Wastewater Pumping Station fails to meet the electrical-installation requirements and encroaches upon the river protection area. (Official letter SP-RCHO-2021-02594 from the Dirección de Ingeniería Regional).
  • f)Urbanización Camino Luna is connected to the Ciudad de Liberia sanitary sewer system without having remedied the legally established requirements. Operation and maintenance within the urban development are the responsibility of the interested parties and/or project developers until the applicable requirements and regulations are met. (See documentation).
  • g)The wastewater treatment system at Residencial Camino Luna and the pumping system managed by the residents are operating normally. (See documentation).
  • h)That the Instituto Costarricense de Acueductos y Alcantarillados provides maintenance for the existing connection between the residential development (urbanización) and the collection networks owned by the Instituto. The institutional systems contain no reports of incidents involving wastewater (aguas residuales) overflowing from the sanitary sewer pipes (tuberías de alcantarillado sanitario) owned by AyA. (see documentation).

III. UNPROVEN FACTS

  • a)That the residential development is facing a public-health or environmental problem associated with wastewater.
  • b)That the connection of Urbanización Camino Luna to the Liberia sanitary sewer system (sistema de alcantarillado sanitario) complies with the requirements legally established by the Instituto Costarricense de Acueductos y Alcantarillados.
  • c)That the records of AyA contain complaints or grievances filed by the petitioner (accionante).
  • d)That the sanitary sewer system of Residencial Camino Luna, Liberia Guanacaste, collapses, thereby causing sewage (aguas negras) to be discharged into the Liberia River.

IV. REGARDING HARM TO HEALTH AND THE ENVIRONMENT

Based on the evidence in the record, the Chamber finds that the wastewater treatment system (sistema de tratamiento de aguas residuales) of Residencial Camino Luna and the pumping system operated by the residents are functioning normally. Likewise, the Instituto Costarricense de Acueductos y Alcantarillados provides maintenance for the existing connection between the residential development and the collection networks owned by the Instituto. The institutional systems contain no reports of incidents involving wastewater overflowing from the sanitary sewer pipes owned by the Instituto Costarricense de Acueductos y Alcantarillados AyA.

Accordingly, any violation of the right to the environment and health by the authorities of the Instituto Costarricense de Acueductos y Alcantarillados is ruled out, as it has been verified that preventive maintenance is performed on the water-supply system (acueducto) belonging to the Instituto and that the systems operate in accordance with the established technical provisions. Therefore, there is no negligence on the part of the respondent authorities (autoridades recurridas) that entails a public-health problem or environmental harm associated with wastewater. Consequently, the application must be denied with respect to this claim.

V. REGARDING THE OPERATION OF THE SANITARY WATER-SUPPLY SYSTEM

COSTS. This Court finds that, through official letter CH-IR-2002-344 of 10 de mayo de 2002, the Jefatura Región Chorotega informed the developers of the Urbanización Camino Luna project of the availability of drinking water (disponibilidad de agua potable). With respect to the sanitary sewer system, they were advised that, to obtain approval, they were required to construct a sanitary sewer network (red de alcantarillo sanitario), pumping station (estación de bombeo), stormwater collection network (red de recolección pluvial), and drinking-water pipeline (cañería potable). It is confirmed that the Proyecto Urbanización Camino Luna lacks sanitary sewer service availability (disponibilidad de alcantarillado sanitario) because of noncompliance with infrastructure requirements, technical regulations, and institutional procedures. Likewise, the Estación de Bombeo de Aguas Residuales fails to comply with the electrical-installation requirements and encroaches upon the river protection area (área de protección del rio).

It is evident that Urbanización Camino Luna is connected to the sanitary sewer system of the Ciudad de Liberia without having remedied the legally established requirements; therefore, operation and maintenance within the residential development are the responsibility of the interested parties and/or the project developers until the applicable requirements and regulations are met.

Based on the foregoing, the Chamber confirms that the Instituto Costarricense de Acueductos y Alcantarillados granted water availability for Urbanización Camino Luna. However, contrary to the petitioner’s assertion, the sanitary sewer system was neither approved nor formally accepted because of technical and regulatory noncompliance. It should be noted that the representatives of the Instituto state that the Estación de Bombeo de Aguas Residuales fails to comply with the electrical-installation requirements and encroaches upon the river protection area. Finally, it is determined that the residential development was unlawfully connected to the sanitary sewer systems. Accordingly, operation and maintenance within the residential development are the responsibility of the interested parties and/or project developers until the applicable requirements and regulations are met, and they must therefore bear the internal costs. The interested party is advised that, if dissatisfied with the charges imposed by the respondent authority, such charges must be challenged through administrative proceedings or ordinary judicial review (legalidad ordinaria), given the competent jurisdiction. Consequently, the application must be denied with respect to this claim.

VI. REGARDING THE REQUESTS SUBMITTED BY THE PETITIONER

By a decision issued at 13:08 hours on 11 de agosto de 2021, this Court ordered the petitioner to provide a complete and legible copy, bearing a receipt stamp or the corresponding proof of transmission by email, of the complaints filed with the authorities of the Instituto Costarricense de Acueductos y Alcantarillados concerning the alleged failure to respond to the complaints or requests submitted. For his part, on 11 de agosto de 2021, the interested party furnished the Chamber with copies of two emails exchanged between Ingeniero Araya García of the Instituto Costarricense de Acueductos y Alcantarillados and Fabián Sánchez León of the company FASAYCO S.A., dated 22 de setiembre de 2010 and 24 de octubre de 2010.

A review of the emails submitted establishes that they are communications between third parties unrelated to these proceedings, referring to the transmission of a report on the pumping station. Therefore, they do not constitute a petition, inquiry, or complaint brought by the petitioner before the Administration. Accordingly, the application must be dismissed with respect to this claim.

VII. INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS

In accordance with the principle of coordination (principio de coordinación) governing environmental matters and the right to health, and given that the representatives of the Instituto Costarricense de Acueductos y Alcantarillados state that the Estación de Bombeo de Aguas Residuales fails to comply with the electrical-installation requirements and encroaches upon the river protection area, coupled with the fact that the reports submitted by the respondent authorities confirm that the residential development was unlawfully connected to the sanitary sewer systems, the appropriate course is for the officials of this Instituto to report this situation to the Ministerio de Salud and the Ministerio de Ambiente y Energía so that they may proceed as required by law.

VIII. NOTE BY MAGISTRADA HERNÁNDEZ LÓPEZ REGARDING THE CLAIM ALLEGING A VIOLATION OF ARTICLE 50 OF THE CONSTITUCIÓN POLÍTICA

1. The historical context that once prompted the Chamber’s extensive involvement in environmental matters has changed considerably, requiring this body to reconsider the conditions governing its participation in safeguarding the right of individuals to a healthy and ecologically balanced environment, as protected by Article 50 of the Constitución Política. Indeed, the current situation—characterized by an extremely broad body of statutory and regulatory law that includes substantive rules, procedures, and the creation of bodies responsible for ensuring compliance with the Fundamental Charter—is radically different from the previous situation, in which the absence of regulations and of government bodies with appropriate jurisdiction compelled the Chamber to assume a leading, almost exclusive, role in defending the aforementioned constitutional right.

2. Today, we are faced with a “dense framework” of environmental regulations, which has produced two significant phenomena: the first and most obvious is the emergence of comprehensive legal regulation of activities whose impact on the environment was previously subject to little or no oversight, as well as the creation of government bodies vested with powers to monitor and control the effects of human activity on the environment. The second phenomenon is that this increasing juridification (juridificación)—predominantly through statutes and regulations—necessarily brings both administrative justice and the ordinary courts into play, primarily the administrative litigation jurisdiction (jurisdicción contencioso administrativo), but also the criminal jurisdiction. In those forums, consistent with the importance of environmental law, broad procedural avenues and inclusive rules of standing (medios de legitimación) have been established so that regulated persons may enforce the provisions of the extensive legal framework relating to environmental matters.

3. In that context, it is inappropriate, both legally and functionally, for the Constitutional Chamber to displace—or, worse still, replace—the ordinary judicial bodies in carrying out their task, itself constitutionally mandated, of ensuring effective compliance with statutes and regulations. It is legally inappropriate because, in the overwhelming majority of these cases, the Chamber is asked to interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies that were specifically created to perform such tasks. It is also functionally inappropriate because the design of its proceedings is ill-suited to the complexity found in numerous environmental disputes, which involve sequences of technically and legally complex facts and acts. There are well-known examples concerning both issues in which the Chamber has issued a partial or technically incomplete decision, or in which unnecessary friction and adverse effects on legal certainty (seguridad jurídica) have arisen.

4. Among the technical considerations I have assessed, I would add that this jurisdiction lacks judges responsible for enforcing judgments (jueces ejecutores de sentencia) who could provide proper follow-up on such judgments—which are generally complex—and which sometimes require monitoring remedial plans, among other measures, with inter-institutional coordination and follow-up lasting months or even years.

5. From that perspective, this Court’s decision to step aside in environmental matters should not be viewed as abandoning environmental protection but, on the contrary, as ensuring its proper protection in the forum best suited to the nature of its complexity and diversity. Nor should it be viewed as this forum declining its duty to protect the constitutional rights entrusted to it by the Constitución Política and its Ley Orgánica, a duty which, in my view, remains reserved in this area for specific cases. Rather, it is an exercise in reallocating the burdens and responsibilities assigned to the various government bodies so that each may fully perform its work within its assigned sphere, as well as an exercise of the power to determine its own jurisdiction, as established in Article 7 of its Ley Orgánica.

6. It is clear that the Chamber does not propose abandoning to other jurisdictions the task of protecting individuals’ rights in environmental matters. It is well known that, although every claim concerning a violation of statutory and regulatory provisions may be brought within the constitutional sphere, there are cases whose resolution requires nothing more than the application of constitutional law. The aim, therefore, is for the Chamber to become one of several protagonists, so that—together, each acting within its own sphere—the full range of situations involved in protecting the right to a healthy and balanced environment can be addressed within a society in which other equally pressing needs also exist. With this position, I firmly believe that citizens do not lose the slightest degree of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers, the latter principle being one that must be taken into consideration because it governs the constitutional dynamics of any liberal and democratic system such as ours.- 7.

In keeping with the foregoing, I maintain that this Chamber should refrain from hearing claims brought before it for alleged violations of Article 50 of the Political Constitution, leaving their consideration to the administrative courts and the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa). The foregoing is stated as a general rule, without prejudice to recognizing the existence of particular cases or groups of cases that, in my view, would still be better protected by this Chamber and therefore should be heard and decided by it.- Among such groups of cases, and without this enumeration being regarded as a closed and definitive list, I may indicate that the Chamber should retain jurisdiction over situations such as claims involving environmental violations that also directly endanger human health or access to or the quality of water; and cases involving gross and direct violations of the environment in which there is a manifest absence of protection by State authorities, provided further that the nature of the claim allows it to be addressed through the remedy of amparo (amparo) as a summary and special procedural mechanism, since I also believe that amparo should not be converted into an ordinary proceeding in order to address, even in the cases cited, matters exceeding its capacity to deal with them adequately.

8. In this specific case, in accordance with the proven facts, the appellant’s claim could potentially pose a risk to human health—the Camino Luna Housing Development Project lacks access to a sanitary sewerage system (alcantarillado sanitario) because of noncompliance with infrastructure requirements, technical regulations, and institutional procedures-. Consequently, it is clear that this is one of the exceptions indicated, and for that reason I have considered it necessary for the Chamber to exercise its jurisdiction in order to verify or rule out whether the alleged omissions violate the fundamental rights of the protected persons.

IX. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is the undersigned’s view that, where the Public Administration has already intervened, consideration and resolution of the matter falls within the contentious-administrative jurisdiction. Nevertheless, I do consider the merits of a case when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as occurs in this case, in which the appellant alleges the malfunctioning of the sanitary sewer system (acueducto sanitario) of Residencial Camino Luna, in Liberia. The foregoing violates the right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.

X.Dissenting opinion of Justice Rueda Leal. In the case under examination (sub examine), the appellant alleges that the Municipalidad de Liberia and the ICAA approved the real-estate development known as Residencial Camino Luna. He states that the houses were built under permits granted by the local government. He adds that the residential development has a sanitary sewer system that pipes the wastewater (aguas residuales) to a tank located beside the río Liberia. He clarifies that none of the houses has a septic tank (tanque séptico). He asserts that the ICAA charges them on every bill for sanitary sewerage service; however, that institution has not taken responsibility for it. He explains that the sanitary sewerage system regularly collapses, causing the water to flow directly into the río Liberia. He complains that the ICAA does not maintain the system or the pumps despite receiving the corresponding payment.

He mentions that the residents have had to cover the maintenance expenses. He challenges the fact that the Municipalidad de Liberia continues granting construction permits in the residential development despite the existing situation. He requests the following relief: “I request that the Instituto Costarricense de Acueductos y Alcantarillados (AyA), Legal Entity ID Nº CED01, be ordered immediately to take responsibility for maintaining the sanitary sewerage systems, as it is required to do and for which, as mentioned, it charges each month. The Municipalidad de Liberia shall likewise be ordered to suspend, and refrain from issuing any further, Construction permits such as those that have been issued at this location, at least until an efficient, prompt, and timely response is received from the Instituto Costarricense de Acueductos y Alcantarillados (AyA), Legal Entity ID Nº CED01, since it is impossible to guarantee to persons who wish or are required to live at this location that they will do so in a healthy and wholesome place, and likewise to guarantee that such sewage will no longer reach (sic) the Rio Liberia, which runs through the Cantón de Liberia and is a tributary of the Rio Tempisque, which is so important in our Country.”

For their part, the ICAA authorities inform the Chamber that the developer never complied with the technical specifications for the sewerage system, pumping station, and wastewater treatment. They add that the works were constructed in violation of the regulations and that, without authorization, the residential development’s wastewater was connected to one of the area’s collector sewers (colectores). They mention that the installed pumping station does not comply with a river protection area (área de protección). They report that in 2009 the irregular connection to Liberia’s sanitary sewerage system was detected, and therefore at that time they decided to maintain and improve the housing development’s existing connection to the collection networks owned by the ICAA. They state that, for this reason, the ICAA charges for collecting the wastewater generated by the homes, but has neither approved nor accepted the sewerage system within the housing development, which it considers to be the responsibility of the interested parties and developers until the applicable regulations are complied with.

They add that the ICAA performs preventive maintenance on its collector sewers, including the one serving Residencial Camino Luna. They assert that the municipality is responsible for requiring, before accepting the works, that they comply with all applicable requirements, which the record does not show to have occurred. They maintain that it is not feasible for the ICAA to assume the costs of works that should be the developer’s responsibility, or to assume responsibilities falling within the jurisdiction of other entities, in this case the local government.

In this regard, although the proceedings were conducted solely against the ICAA, it is nonetheless true that the application expressly shows that the petitioner also brings the amparo against the Municipalidad de Liberia for alleged acts and omissions relating to environmental matters. Indeed, the ICAA authorities attribute responsibility for the facts to the Municipalidad de Liberia. Consequently, I consider that, before issuing the ruling required by law, the scope of the remedy should be expanded and a report requested from the mayor of that locality so that he may respond to the allegations attributed to the entity he represents.

Likewise, given that the majority deems it proven that the Wastewater Pumping Station encroaches upon the protection area of a river and that the appellant expressly alleges contamination of the río Liberia with sewage and wastewater, I consider it essential to expand the remedy to include the Ministerio de Salud and the Ministerio de Ambiente y Energía so that they may address the facts that are the subject of this proceeding.

XI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, they must retrieve them from the court office within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at Session N° 27-11 of 22 de agosto de 2011, Article XXVI, and published in Boletín Judicial N° 19 of 26 de enero de2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at Session N° 43-12 held on 3 de mayo de 2012, Article LXXXI.

POR TANTO:

The remedy is denied. Justice Hernández López issues a note. Justice Salazar Alvarado issues a note. Justice Rueda Leal dissents and orders that the remedy be expanded against the Municipalidad de Liberia, the Ministerio de Salud, and the Ministerio de Ambiente y Energía. Natalie Montiel Ulloa, Deputy Manager of Peripheral Systems, Álvaro Araya García, Director of UEN RyT Peripheral Systems, and Wander Cubero Hurtado, Head of the Liberia Cantonal Office of the Instituto Costarricense de Acueductos y Alcantarillados, shall take note of the matters set forth in recital (considerando) VII of this decision. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diez horas seis minutos del tres de setiembre de dos mil veintiuno .

Recurso de amparo que se tramita en el expediente N° 21-015543- 0007-CO, interpuesto por Nombre01, portador de la cédula de identidad CED02, contra el Instituto Costarricense de Acueductos y Alcantarillados.

RESULTANDO:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 7:42 horas del 10 de agosto de 2021, el recurrente interpone recurso de amparo contra el Instituto Costarricense de Acueductos y Alcantarillados. Afirma el accionante que es propietario de la finca inscrita con la matrícula de folio real número , ubicada en Liberia, Guanacaste, Dirección01, Dirección02. Dice que el residencial cuenta con las aprobaciones y permisos emitidos por la Municipalidad de Liberia y el Instituto Costarricense de Acueductos y Alcantarillados, por lo que se han construido casas de habitación. Existe un acueducto sanitario, el cual se encarga de entubar las aguas residuales. Las viviendas no tienen tanque séptico porque el tipo de suelo no permite su correcto funcionamiento. Agrega que el servicio de alcantarillado sanitario colapsa de forma regular y las aguas negras son vertidas en el río Liberia, sin haber pasado por las lagunas de tratamiento.Reclama que el instituto no da mantenimiento al sistema de alcantarillado sanitario y a las bombas, a pesar de que se realiza el cobro por dicho servicio. Manifiesta que ante tal situación, un grupo de vecinos se dio a la tarea de sufragar los gastos de mantenimiento del sistema de alcantarillado sanitario, con el propósito de no poner en riesgo la salud de la comunidad y garantizar el derecho a un ambiente sano y ecológicamente equilibrado. Impugna la omisión, por parte de los recurridos, de brindar mantenimiento a la planta de tratamiento y evitar que las aguas negras alcancen el río Liberia, el cual es un afluente del río Tempisque, uno de los ríos más importantes de su país. Explica que ha formulado varias gestiones ante el instituto sobre la planta de rebombeo del Residencial Camino de Luna y la falta de mantenimiento. Acota que las autoridades recurridas tienen pleno conocimiento de los problemas de la planta de tratamiento y el alcantarillado sanitario del residencial. Considera que los hechos expuestos violentan sus derechos fundamentales.
  2. 2Mediante resolución de las 13:08 horas de 11 de agosto de 2021, la Sala previno al accionante aportar copia íntegra, legible y con sello de recibido o el respectivo comprobante de remisión de correo electrónico, de las denuncias interpuestas antes las autoridades recurridas en relación con los hechos referidos en el escrito de interposición de este recurso.
  3. 3Que el 11 de agosto de 2021, el accionante remite a la Sala copias de dos correos electrónicos entre el Ingeniero Araya García del Instituto Costarricense de Acueductos y Alcantarillados y Fabián Sánchez León de la empresa FASAYCO S.A., comunicaciones fechadas el 22 de setiembre de 2010 y 24 de octubre de 2010.
  4. 4Mediante resolución de las 9:18 horas del 19 de agosto de 2021, se dio curso al presente recurso de amparo y se otorgó audiencia al Subgerente y al Jefe de la UEN Recolección y Tratamiento de la Subgerencia de Gestión de Sistemas Periféricos, además del Jefe de la Oficina Cantonal de Liberia del Instituto Costarricense de Acueductos y Alcantarillados.
  5. 5Mediante escrito presentado el 24 de agosto de 2021, Natalie Montiel Ulloa, Subgerente de Sistemas Periféricos, Álvaro Araya García, Director de la UEN RyT Sistemas Periféricos y Wander Cubero Hurtado, Jefe de la Oficina Cantonal de Liberia del Instituto Costarricense de Acueductos y Alcantarillados informan que el Instituto al momento de otorgar la disponibilidad de servicios de previo a la construcción de la Urbanización, indicó al desarrollador que para poder habilitar la recolección y tratamiento de las aguas residuales, debía realizar obras las cuales deben ajustarse a las normas técnicas de AyA (redes sanitarias, estación de bombeo y eventualmente planta de tratamiento de aguas residuales) y una vez finalizadas, entregarlas formalmente al Instituto para su recepción, operación y mantenimiento, indicándosele de forma expresa, que en ningún momento, el otorgamiento de ese documento de "disponibilidad de alcantarillado sanitario" implicaba tener por aprobado el proyecto, ni mucho menos las obras, pues éstas requieren de revisión para verificar el cumplimiento a las normas técnicas.No obstante, el cumplimiento a ese deber por parte del privado nunca existió, de modo contrario, construyó las obras al margen de la normativa y sin autorización del Instituto conectó las aguas residuales del residencial a uno de los colectores de la zona. El alcantarillado sanitario debe recoger por gravedad las aguas residuales de una residencial, condominio o bien una urbanización. Igualmente, por un principio de continuidad el inicio de las redes es con un diámetro pequeño al que se va sumando agua hasta alcanzar un tubo de "llegada" con un diámetro considerable. En el momento en que se llevó a cabo la concepción del proyecto denominado "Camino Luna", el proyectista para dotar de alcantarillado a una urbanización que por condiciones de baja tasa de infiltración del suelo, no permitía el uso de tanque séptico, debía poner una Estación de Bombeo de Aguas Residuales (EBAR), en caso que el sistema de la ciudad (las lagunas) tuvieran capacidad de tratamiento o bien construir una Planta de Tratamiento de Aguas Residuales (PTAR), si se le denegaba dicho permiso.El instalar una Estación de Bombeo de Aguas Residuales conlleva una serie de requerimientos, el primero de ellos es respetar el área de protección del río, que en este caso no se cumple. El tanque que menciona el Sr. Nombre01, no es un tanque, es una cisterna de bombeo de las Aguas Residuales, que forma parte de un compendio de estructuras que no se recibieron en su momento, pues no cumplían con lo requerido por la institución, concluyéndose que la conexión de esta urbanización al sistema de saneamiento de la Ciudad de Liberia en apariencia se realizó de forma irregular y sin la autorización formal por parte de AyA. En el año 2009 durante el proceso de sustitución de la tubería de alcantarillado sanitario cercana a la urbanización -parte del mantenimiento que brinda AyA a la infraestructura bajo su administración y operación-, se identificó que la misma estaba interconectada a la red alcantarillado sanitario - oficio N° GSPRCH-CL-2021-O0975-.Una vez identificada lo que en apariencia constituye una conexión irregular al alcantarillado sanitario de Liberia, se procedió a valorar lo establecido por la Autoridad Reguladora de los Servicios Públicos (ARESEP) en relación con la imposibilidad de la suspensión del servicio de alcantarillado sanitario, así como el riesgo a la salud pública que la eventual suspensión o desconexión del servicio de alcantarillado sanitario representaba, toda vez que el proyecto se diseñó y construyó considerando una solución de alcantarillado sanitario y no con tanque séptico. Los funcionarios responsables en su momento, tomaron la decisión de mantener y mejorar la conexión existente de la Urbanización a las redes de recolección propiedad de AyA, cobrándose lo correspondiente a la recolección de las aguas residuales generadas por las viviendas que la componen, bajo el entendido que AyA no ha aprobado ni recibido el sistema de alcantarillado a lo interno de la Urbanización, siendo que su operación y mantenimiento -a lo interno de la urbanización- es completa responsabilidad de los interesados y/o desarrolladores del proyecto, hasta tanto se cumpla con los requisitos y normativa aplicable.Ante un evento que pueda poner en riesgo la salud pública por desbordamiento de aguas residuales en Liberia, la Unidad Cantonal está en la capacidad de atender el evento conforme los procedimientos Institucionales establecidos, para lo cual los usuarios cuentan con los canales de comunicación oficialmente establecidos por AyA. El Instituto da mantenimiento preventivo a sus colectores, entre los cuales se encuentra el del Residencial Camino Luna. No es viable ni legal, ni financieramente para el AyA asumir costos de obras que deben ser responsabilidad del desarrollador, ni tampoco asumir responsabilidades que son competencia de otras entidades, en este caso de gobierno local, no puede el Instituto desapartarse de sus propias normas, ni desaplicarlas para el caso concreto en una flagrante violación al principio de legalidad constitucional y administrativa, por cuanto las obras para el sistema de saneamiento, en este caso a lo interno del residencial debe cumplir con los requisitos técnicos establecidos.
  6. 6En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Salazar Alvarado; y,

CONSIDERANDO:

I. OBJETO DEL RECURSO

Acusa el accionante lesión a sus derechos fundamentales por las siguientes razones: 1) El alcantarillado sanitario del Residencial Camino Luna, Liberia Guanacaste, de forma regular colapsa, y por ello las aguas negras son vertidas en el río Liberia. 2) Que las autoridades del Instituto Costarricense de Acueductos y Alcantarillados no brindan mantenimiento al sistema de alcantarillado sanitario, a pesar de pagar el servicio. 3) Ha presentado múltiples gestiones relacionadas con la planta de rebombeo y a la fecha no se han sido contestadas.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)Los proyectos de urbanización que requieran disponibilidad de alcantarillado sanitario deben cumplir las normas técnicas y legales para su aprobación por parte del Instituto Costarricense de Acueductos y Alcantarillado. (ver documentación).
  • b)Por oficio CH-IR-2002-344 de 10 de mayo de 2002, la Jefatura Región Chorotega comunica a los desarrolladores del proyecto Urbanización Camino Luna la disponibilidad de agua potable. Para el alcantarillado sanitario se previene que para su aprobación debe construir: red de alcantarillo sanitario, estación de bombeo, red de recolección pluvial y cañería potable. (ver documentación).
  • c)El Proyecto Urbanización Camino Luna, ubicado en el distrito Liberia, provincia Guanacaste, plano catastro G-752513-2001 cuenta con la aprobación de planos constructivos (oficio URB. 2003-0108 de fecha 14 de mayo de 2003).
  • d)El Proyecto Urbanización Camino Luna no cuenta con disponibilidad de alcantarillado sanitario por el incumplimiento de infraestructura, normativa técnica y procedimientos institucionales. (ver documentación).
  • e)La Estación de Bombeo de Aguas Residuales incumple los requisitos de instalación eléctrica e irrespeta el área de protección del rio. (oficio SP-RCHO-2021-02594 de la Dirección de Ingeniería Regional).
  • f)La Urbanización Camino Luna se encuentra conectada al sistema de alcantarillado sanitario de la Ciudad de Liberia sin la subsanación de los requisitos legalmente establecidos. La operación y mantenimiento a lo interno de la urbanización es responsabilidad de los interesados y/o desarrolladores del proyecto, hasta tanto se cumpla con los requisitos y normativa aplicable. (ver documentación).
  • g)El sistema de tratamiento de aguas residuales del residencial Camino Luna y el bombeo que administran los vecinos se encuentra operando de forma normal. (ver documentación).
  • h)Que el Instituto Costarricense de Acueductos y Alcantarillados brinda mantenimiento a la conexión existente entre la urbanización y las redes de recolección propiedad de Instituto. No se registran en los sistemas Institucionales reportes de eventos relacionados con el desbordamiento de aguas residuales provenientes de las tuberías de alcantarillado sanitario propiedad de AyA. (ver documentación).

III. HECHOS NO PROBADOS

  • a)Que el residencial se encuentre enfrentando un problema de salud pública o de afectación al ambiente asociado al tema de las aguas residuales.
  • b)Que la conexión de la Urbanización Camino Luna al sistema de alcantarillado sanitario de Liberia cumpla los requisitos legalmente establecidos por el Instituto Costarricense de Acueductos y Alcantarillados.
  • c)Que consten en los registros de AyA denuncias o quejas presentadas por el accionante.
  • d)Que el alcantarillado sanitario del Residencial Camino Luna, Liberia Guanacaste colapse y por ello las aguas negras son vertidas en el río Liberia.

IV. SOBRE EL DAÑO A LA SALUD Y AL AMBIENTE

De la prueba que consta en autos, la Sala comprueba que el sistema de tratamiento de aguas residuales del residencial Camino Luna y el bombeo que administran los vecinos se encuentra operando de forma normal. Asimismo, el Instituto Costarricense de Acueductos y Alcantarillados brinda mantenimiento a la conexión existente entre la urbanización y las redes de recolección propiedad de Instituto. No se registran en los sistemas Institucionales reportes de eventos relacionados con el desbordamiento de aguas residuales provenientes de las tuberías de alcantarillado sanitario propiedad del Instituto Costarricense de Acueductos y Alcantarillados AyA.

Por lo anterior, se descarta la lesión al derecho al ambiente y a la salud por parte de las autoridades del Instituto Costarricense de Acueductos y Alcantarillados al verificarse que se da mantenimiento preventivo al acueducto perteneciente al Instituto y los sistemas funcionan de acuerdo a las disposiciones técnicas establecidas. De ahí que, no existe negligencia por parte de las autoridades recurridas que implique un problema de salud pública, o de afectación al ambiente asociado al tema de las aguas residuales. En consecuencia, lo procedente es declarar sin lugar el recurso en este extremo.

V. SOBRE EL FUNCIONAMIENTO DEL ACUEDUCTO SANITARIO

COSTOS. Este Tribunal comprueba que mediante oficio CH-IR-2002-344 de 10 de mayo de 2002, la Jefatura Región Chorotega comunica a los desarrolladores del proyecto Urbanización Camino Luna la disponibilidad de agua potable. Para el alcantarillado sanitario se previene que para su aprobación debe construir: red de alcantarillo sanitario, estación de bombeo, red de recolección pluvial y cañería potable. Se corrobora que el Proyecto Urbanización Camino Luna no cuenta con disponibilidad de alcantarillado sanitario por el incumplimiento de infraestructura, normativa técnica y procedimientos institucionales. Igualmente, la Estación de Bombeo de Aguas Residuales incumple los requisitos de instalación eléctrica e irrespeta el área de protección del rio. Vemos que la Urbanización Camino Luna se encuentra conectada al sistema de alcantarillado sanitario de la Ciudad de Liberia sin la subsanación de los requisitos legalmente establecidos, por ello la operación y mantenimiento a lo interno de la urbanización es responsabilidad de los interesados y/o desarrolladores del proyecto, hasta tanto se cumpla con los requisitos y normativa aplicable.

De lo anterior, la Sala corrobora que el Instituto Costarricense de Acueductos y Alcantarillados otorgó la disponibilidad de agua para la Urbanización Camino Luna. Empero, contrario a lo afirmado por el accionante no se aprobó ni se recibió formalmente el alcantarillado sanitario por incumplimientos técnicos y normativos. Nótese que los personeros del Instituto establecen que la Estación de Bombeo de Aguas Residuales incumple los requisitos de instalación eléctrica e irrespeta el área de protección del rio. Finalmente, se determina que de forma ilegítima se procedió a la conexión del residencial a los sistemas de alcantarillado sanitario. Por lo expuesto, la operación y mantenimiento a lo interno de la urbanización es responsabilidad de los interesados y/o desarrolladores del proyecto, hasta tanto se cumpla con los requisitos y normativa aplicable, y por ello deben asumir los costos internos. Se aclara a la parte interesada que en caso de encontrarse disconforme con los cobros efectuados por la autoridad recurrida deberá discutirlos en la vía administrativa o legalidad ordinaria en razón de su competencia. En consecuencia, lo procedente es declarar sin lugar el recurso en este extremo.

VI. SOBRE LAS GESTIONES PLANTEADAS POR EL RECURRENTE

Este Tribunal por resolución de las 13:08 horas de 11 de agosto de 2021, previno al accionante aportar copia íntegra, legible y con sello de recibido o el respectivo comprobante de remisión de correo electrónico, de las denuncias interpuestas antes las autoridades del Instituto Costarricense de Acueductos y Alcantarillados en cuanto a la omisión de respuesta a las denuncias o gestiones planteadas. Por su parte, el interesado el 11 de agosto de 2021, entregó a la Sala copia de dos correos electrónicos entre el Ingeniero Araya García del Instituto Costarricense de Acueductos y Alcantarillados y Fabián Sánchez León de la empresa FASAYCO S.A., comunicaciones fechadas el 22 de setiembre de 2010 y 24 de octubre de 2010.

De la lectura de los correos aportados, se comprueba la comunicación de terceros ajenos a este proceso, quienes se refieren a la remisión de un informe de la estación de bombeo. De manera que no estamos en presencia de una petición, consulta o denuncia incoada por el accionante ante la Administración. Por lo anterior, lo procedente es desestimar el recurso en este extremo.

VII. INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS

De conformidad con el principio de coordinación que rige en materia ambiental y el derecho a la salud, y dado que los personeros del Instituto Costarricense de Acueductos y Alcantarillados establecen que la Estación de Bombeo de Aguas Residuales incumple los requisitos de instalación eléctrica e irrespeta el área de protección del rio. Aunado a que los informes rendidos por las autoridades recurridas corroboran que de forma ilegítima se procedió a la conexión del residencial a los sistemas de alcantarillado sanitario, lo procedente es que los funcionarios de este Instituto comuniquen esta situación al Ministerio de Salud y al Ministerio de Ambiente y Energía para proceder como en derecho corresponda.

VIII. NOTA DE LA MAGISTRADA HERNÁNDEZ LÓPEZ RESPECTO DEL RECLAMO POR INFRACCIÓN DEL ARTÍCULO 50 DE LA CONSTITUCIÓN POLÍTICA

1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constitución Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista, casi único, en la defensa del precitado derecho constitucional.

2. Hoy en día, nos encontramos frente a un “denso entramado” de normativa ambiental, lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación –predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativo, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.

3. En ese contexto, no resulta apropiado jurídicamente, ni desde el punto de vista funcional, que la Sala Constitucional desplace, o -peor aún- sustituya, a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.

4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.

5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado, así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.

6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro.- 7.

En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.

8. En el caso concreto, de conformidad con los hechos probados, el reclamo de la parte recurrente, podría eventualmente incidir como un riesgo en salud de las personas -El Proyecto Urbanización Camino Luna no cuenta con disponibilidad de alcantarillado sanitario por el incumplimiento de infraestructura, normativa técnica y procedimientos institucionales-. En consecuencia, es claro que estamos ante una de las excepciones indicadas y por esa razón he considerado necesario que la Sala ejerciera su competencia, para comprobar o descartar si las omisiones señaladas, vulneran los derechos fundamentales de las personas amparadas.

IX. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa el mal funcionamiento del acueducto sanitario del Residencial Camino Luna, en Liberia. Lo anterior, en violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

X.Voto salvado del magistrado Rueda Leal. En el sub examine, el recurrente acusa que la Municipalidad de Liberia y el ICAA aprobaron el desarrollo inmobiliario denominado Residencial Camino Luna. Señala que las casas fueron construidas con permisos otorgados por el gobierno local. Acota que el residencial cuenta con un acueducto sanitario que entuba las aguas residuales y las traslada a un tanque ubicado al lado del río Liberia. Aclara que ninguna casa tiene tanque séptico. Aduce que el ICAA les cobra en cada recibo el rubro correspondiente al alcantarillado sanitario; empero, este no ha sido asumido por esa institución. Expone que el alcantarillado sanitario colapsa regularmente, por lo que las aguas caen directamente en el río Liberia. Reprocha que el ICAA no da mantenimiento al sistema ni a las bombas pese a que reciben el pago correspondiente. Menciona que los vecinos han tenido que cubrir los gastos de mantenimiento.

Cuestiona que la Municipalidad de Liberia continúa otorgando permisos de construcción en el residencial a pesar de la situación existente. Formula las siguientes petitorias: “Solicito se le ordene de manera inmediata al Instituto Costarricense de Acueductos y Alcantarillados (AyA) Cédula Jurídica Nº CED01 se encargue del mantenimiento de los sistemas de alcantarillado sanitario tal y como le corresponde y que como se ha mencionado cobra mes a mes. Se le ordene a la Municipalidad de Liberia, asimismo a suspender y que no se otorguen más, permisos de Construcción que han sido otorgados en este lugar al menos hasta el momento en que se cuente con una respuesta eficiente, ágil y oportuna del Instituto Costarricense de Acueductos y Alcantarillados (AyA) Cédula Jurídica Nº CED01 toda vez que es imposible garantizar a las personas que quieran o deban habitar en este lugar que lo harán en un lugar sano y saludable, lo mismo que se garantice que esas aguas negras no alcanzaran mas (sic) el Rio Liberia recorre el Cantón de Liberia y es un afluente del Rio Tempisque tan importante en nuestro País”.

Por su parte, las autoridades del ICAA informan a la Sala que el desarrollador nunca cumplió las especificaciones técnicas del sistema de alcantarillado, estación de bombeo y tratamiento de aguas residuales. Añaden que se construyeron las obras al margen de la normativa y sin autorización se conectaron las aguas residuales del residencial a uno de los colectores de la zona. Mencionan que la estación de bombeo colocada no cumple con el área de protección de un río. Refieren que en 2009 se detectó la conexión la conexión irregular al alcantarillado sanitario de Liberia, por lo que en ese momento tomaron la decisión de mantener y mejorar la conexión existente de la urbanización a las redes de recolección propiedad del ICAA. Comentan que, por lo anterior, el ICAA cobra lo correspondiente a la recolección de las aguas residuales generadas por las viviendas, pero no ha aprobado ni recibido el sistema de alcantarillado a lo interno de la urbanización, lo cual considera es responsabilidad de los interesados y desarrolladores hasta tanto se cumpla la normativa aplicable.

Acotan que el ICAA da mantenimiento preventivo a sus colectores, entre los cuales se encuentra el del Residencial Camino Luna. Aseveran que la municipalidad tiene la responsabilidad de exigir, previo a la entrega de las obras, que estas cumplan todos los requisitos correspondientes, lo cual no consta que haya ocurrido. Sostienen que no es viable que el ICAA asuma costos de obras que deben ser responsabilidad del desarrollador, ni tampoco asumir responsabilidades que son competencia de otras entidades, en este caso de gobierno local.

Al respecto, si bien el proceso se cursó únicamente en contra del ICAA, no menos cierto es que, en el escrito de interposición, se observa expresamente que el accionante también plantea el amparo en contra de la Municipalidad de Liberia, por presuntas acciones y omisiones relacionadas con aspectos de carácter ambiental. Incluso, las autoridades del ICAA le imputan la responsabilidad de los hechos a la Municipalidad de Liberia. En consecuencia, considero que, previo a resolver lo que en derecho corresponda, se debe ampliar el recurso y solicitar informe al alcalde de esa localidad, a fin de que se pronuncie sobre los reproches que se le atribuyen a su representada.

Asimismo, visto que, la mayoría tiene por demostrado que la Estación de Bombeo de Aguas Residuales irrespeta el área de protección de un rio y que la parte recurrida acusa expresamente la contaminación del río Liberia con aguas negras y residuales, estimo imprescindible ampliar el recurso contra el Ministerio de Salud y el Ministerio de Ambiente y Energía, a efectos de que se refieran a los hechos objeto de este recurso.

XI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero de2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.

POR TANTO:

Se declara sin lugar el recurso. La Magistrada Hernández López pone nota. El Magistrado Salazar Alvarado pone nota. El magistrado Rueda Leal salva el voto y ordena ampliar el recurso en contra de la Municipalidad de Liberia, el Ministerio de Salud y el Ministerio de Ambiente y Energía. Tomen nota Natalie Montiel Ulloa, Subgerente de Sistemas Periféricos, Álvaro Araya García, Director de la UEN RyT Sistemas Periféricos y Wander Cubero Hurtado, Jefe de la Oficina Cantonal de Liberia del Instituto Costarricense de Acueductos y Alcantarillados de lo expuesto en el considerando VII de esta resolución.
