CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at ten hours and six minutes on the third of September two thousand twenty-one.

Motion for non-execution (gestión de inejecución) filed in the constitutional protection petition (recurso de amparo) processed under expediente N° 20-012211-0007-CO, brought by Nombre01, national identification number CED01, against THE TRIBUNAL AMBIENTAL ADMINISTRATIVO.

Recitals:

  1. 1By written submission filed with the Chamber's Secretariat at 11:54 hours on August 17, 2021, the petitioning party brings a motion for non-execution with respect to Judgment No. 20-012211-0007-CO, on the grounds that the Tribunal Ambiental Administrativo has not managed, convened an oral and public hearing for, or concluded administrative case file 410-09-02-TAA, and has therefore failed to comply with this Tribunal's order. The petitioner requests that the Chamber grant the filed motion.
  2. 2By order of the Reporting Magistrate at 8:05 hours on August 29, 2021, a hearing was granted to Ligia Umaña Ledezma in her capacity as Presiding Judge (Jueza Titular) of the Tribunal Ambiental Administrativo and as case-managing judge (Jueza Tramitadora) of case files ending in 02-TAA, so that she could respond and provide the corresponding evidence regarding the facts and omissions attributed to her.
  3. 3Elizabeth Araya Jiménez, in her capacity as Acting Secretary (Secretaría a.i.) of the Tribunal Ambiental Administrativo, reports under oath that: "the corresponding Oral and Public Hearing has not been able to take place: 1- That appearing at pages (folios) 2940 to 2943 of the case file is Official Letter No. 42-2021-TM, signed by Licda. Alexandra González Arguedas, in her capacity as Secretary of this Tribunal, by which she presents her recusal (inhibición) from the present case file. 2- That appearing at page 2944 of the case file is Official Letter No. 54-21-TAA, signed by Lic. Gerardo Mora Zúñiga and Msc. Adriana Bejarano Alfaro, in their capacities as President and Vice-President respectively of this Office, addressed to Licda. Carta Agüero Zeledón, in her capacity as substitute judge (juez suplente) of this Tribunal. 3- That by resolution number 170-21-TAA of 13 hours 31 minutes on February 26, 2021, visible at pages 2956 to 2990, Official Letter 54-21-TM dated January 25, 2021 is annulled, the recusal proceedings (diligencias de abstención) of Secretary Judge Alexandra González Arguedas are approved, and it is agreed to appoint a substitute judge to sit on the Tribunal as Secretary to hear the present case file. 4- That by Official Letter DAJ-0083-2021 dated March 8, 2021, signed by Lcda.Maricela Rodríguez Porras, substitute judge, she presents her recusal from case file 410-09-02-TAA, the foregoing appearing at pages 3053 and 3054. 5- That by resolution 234-21-TM of 07 hours 05 minutes on March 16, 2021, visible at pages 3058 and 3059, this Tribunal agrees to approve the recusal proceedings of Substitute Judge Maricela Rodríguez Porras and to appoint a substitute judge to sit on the Tribunal. 6- That by Official Letter No. TM-207-21-TAA dated March 16, 2021, Licenciada Elizabeth Araya Jiménez is appointed as Substitute Judge to hear in its entirety case file No. 410-09-02-TM through to the issuance of its Final Administrative Act (Acto Final). (…) That by Resolution No. 1110-2021-TAA of 07 hours 40 minutes on August 26, 2021, this Office proceeds pursuant to Articles 21 and 50 of the Political Constitution, as well as Articles 103, 106, 107, 108, 109, 110, and 111 of the Ley Orgánica del Ambiente, Articles 1, 22, and 26 of Executive Decree number 34136-MNAE, the Rules of Procedure of the Tribunal Ambiental Administrativo in relation to Articles 297, 302, 316, and 311 of the Ley General de la Administración Pública, and Article 316 of the Code of Civil Procedure: In light of the foregoing, this Tribunal considers it appropriate to reschedule the ORAL AND PUBLIC HEARING to 08 HOURS 00 MINUTES ON NOVEMBER 3 AND 4, 2021, all dates to be held at the facilities of this Tribunal.Resolution number 2156-2020-TAA of eight hours and forty-five minutes on July twenty-eighth, two thousand twenty, as well as Resolution No. 3035-2020-TAA of thirteen hours and thirty minutes on November fifth, two thousand twenty, AMP AQ REGARDING THE CHARGES BROUGHT, remain fully valid in all other respects. I. In Judgment N° 2020-017177 of 09:20 hours on September 11, 2020, it was ordered

"The petition is declared partially granted against the Tribunal Ambiental Administrativo and the Área Rectora de Salud de Santo Domingo de Heredia. Ligia Umaña Ledezma, in her capacity as Presiding Judge of the Tribunal Ambiental Administrativo and as case-managing judge of case files ending in 02-TAA, or whoever holds that position in her place, is ordered to take all necessary steps to ensure that case file No. 410-09-02-TAA is resolved as required by law and that the ruling is notified to the protected party, all within a period of no more than 2 months, counted from the hearing to be held on September 1, 2020. Likewise, Pedro González Morera, in his capacity as Vice Minister of Health, or whoever holds that position in his place, is ordered to take all necessary steps to follow up on resolution 001252-F-S1-2020 (…)."

II. REGARDING THE FIRST MOTION FOR NON-EXECUTION

By interlocutory judgment No. 2021007879 of 9:40 hours on April 20, 2021, this Tribunal found the non-compliance alleged by the petitioning party and ruled:

"II.- REGARDING THE MOTION FILED. The petitioning party alleges that what was ordered by this Tribunal in the above-cited Judgment has not been complied with. Now, given that the certificate issued by the Judicial Technician and the Secretary of this Chamber on April 9, 2021, shows that the respondent authority failed to submit the report that was required of it regarding the alleged non-compliance with the provisions of the aforementioned Judgment, pursuant to Article 45 of the Ley de la Jurisdicción Constitucional, this Chamber must take the facts alleged by the petitioner as true, and therefore must grant the motion for non-execution filed, with the consequences set forth in the operative part.

Por tanto:

Ligia Umaña Ledezma, in her capacity as Presiding Judge of the Tribunal Ambiental Administrativo and as case-managing judge of case files ending in 02-TAA, or whoever holds that position, is reiterated the order to comply with the provisions of Judgment N° 2020-017177 of 09:20 hours on September 11, 2020, under warning that referral of case documents (testimonio de piezas) to the Ministerio Público will be ordered for the offense provided for in Article 71 of the Ley de la Jurisdicción Constitucional. This Judgment shall be personally notified to the respondent."

III. REGARDING THE MOTION FILED

In the present matter, the petitioner brings a motion for non-execution with respect to Judgment N° 2020-017177 of 09:20 hours on September 11, 2020, which ordered that case file No. 410-09-02-TAA be resolved as required by law and that the ruling be notified to the protected party within a period of no more than two months. While the respondent authority's sworn report indicates that multiple steps have been taken in the processing of the case file, which delayed the issuance of the final administrative act, the fact remains that nearly one year has elapsed since the order was issued to resolve the complaint, making such justification inadmissible at this stage. In light of the foregoing considerations, the appropriate course of action is to grant the motion filed.

IV. DOCUMENTS SUBMITTED TO THE CASE FILE

The petitioning party is hereby notified that if any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, have been submitted, they must be retrieved from the Office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Plenary Court in session No. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in session No. 43-12 held on May 3, 2012, Article LXXXI.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diez horas seis minutos del tres de setiembre de dos mil veintiuno .

Gestión de inejecución presentada en el recurso de amparo que se tramita en expediente N° 20-012211-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra EL TRIBUNAL AMBIENTAL ADMINISTRATIVO.

Resultando:

  1. 1Por escrito presentado en la Secretaría de la Sala a las 11:54 horas del 17 de agosto de 2021, la parte recurrente plantea una gestión de inejecución en relación con la sentencia No. 20-012211-0007-CO, toda vez que el Tribunal Ambiental Administrativo no ha gestionado, convocado a audiencia oral y pública y mucho menos finalizado el expediente administrativo 410-09-02-TAA, por lo que no ha cumplido con lo dispuesto por este Tribunal. Solicita a la Sala que acoja la gestión incoada.
  2. 2Mediante resolución de Magistrado Instructor de las 8:05 horas del 29 de agosto de 2021, se confirió audiencia a Ligia Umaña Ledezma en su condición de Jueza Titular de Tribunal Ambiental Administrativo y como Jueza Tramitadora de los expedientes finalizados en 02-TAA, para que se refiriera y aportara las pruebas correspondientes respecto a los hechos y omisiones que se le atribuyen.
  3. 3Informa bajo juramento Elizabeth Araya Jiménez en su condición de Secretaría a.i del Tribunal Ambiental Administrativo, que: “no se ha podido realizar la correspondiente Audiencia Oral y Publica: 1- Que consta a folios 2940 al 2943 del expediente. el oficio N° 42-2021-TM, suscrito por la Licda. Alexandra González Arguedas. en su condición de Secretaria de este Tribunal, con el que presenta inhibición del presente expediente. 2- Que consta a folio 2944 del expediente, Oficio N° 54-21-TAA, firmado por el Lic. Gerardo Mora Zúñiga y la Msc. Adriana Bejarano Alfaro. en su condición de Presidente y Vicepresidenta respectivamente de este Despacho dirigido a la Licda. Carta Agüero Zeledón, en su condición de Juez suplente de este Tribunal. 3- Que mediante resolución número 1 70-21-TAA de las 13 horas 31 minutos del 26 de febrero de 2021, visible a folios 2956 a 2990, se anula el oficio 54-21-TM de fecha 25 de enero del 2021 y aprueba las diligencias de abstención de la jueza secretaria Alexandra González Arguedas y acuerda nombrar un juez suplente para integrar el Tribunal como Secretario para conocer el presente expediente. 4- Que mediante oficio DAJ-0083-2021 de fecha 08 de marzo del 2021, suscrito por la Lcda.Maricela Rodríguez Porras, juez suplente, presenta inhibición del expediente 410-09-02-TAA, lo anterior visible a folios 3053 y 3054. 5- Que mediante resolución 234-21-TM de las 07 horas 05 minutos del 16 de marzo del 2021, visible a folios 3058 y 3059, este Tribunal acuerda aprobar las diligencias de abstención de la Jueza Suplente Maricela Rodríguez Porras y nombrar a un juez suplente para integrar el Tribunal. 6- Que mediante oficio No. TM-207-21-TAA de fecha 16 de marzo del año 2021 se procede a nombrar a la Licenciada Elizabeth Araya Jiménez Jueza Suplente para que conozca en su totalidad del expediente No. 410-09-02- TM hasta su dictado de Acto Final. (…) Que mediante Resolución No.1110-2021-TAA de las 07 horas 40 minutos del día 26 de agosto del año 2021 este Despacho procede de conformidad a los artículos 21 y 50 de la Constitución Política, así como los preceptos 103, 106, 107, 108, 109, 110 y 111 de la Ley Orgánica del Ambiente. 1, 22 y 26 del Decreto Ejecutivo número 34136-MNAE, Reglamento de Procedimientos del Tribunal Ambiental Administrativo en relación con los artículos 297, 302, 316 y 311 de la Ley General de la Administración Pública, y el artículo 316 del Código Procesal Civil: Lo anterior, este Tribunal considera pertinente reprogramar la celebración de AUDIENCIA ORAL_Y PUBLICA para las 08 HORAS 00 MINUTOS DEL 03 Y 04 DE NOVIEMBRE DEL AÑO 2021, todas las fechas a celebrarse en las instalaciones En las Instalaciones de este Tribunal.Se mantiene Valida en todo lo demás la resolución número 2156-2020- TAA de las ocho horas con cuarenta Y cinco minutos del día veintiocho de julio del año dos mil veinte, así como la Resolución No. 3035-2020-TAA de las trece horas con treinta minutos del día cinco de noviembre del dos mil veinte AMP AQ LA IMPUTACIÓN DE CARGOS. Conservando así la fundamentación legal del proceso, así como las previsiones en cuanto a testigos. abogados y partes.”
  4. 4En la substanciación del proceso se han observado las prescripciones legales.

Redacta la Magistrada Esquivel Rodríguez; y,

Considerando:

I. En la sentencia N° 2020-017177 de las 09:20 horas del 11 de septiembre de 2020, se dispuso

“Se declara parcialmente con lugar el recurso, en contra del Tribunal Ambiental Administrativo y Área Rectora de Salud de Santo Domingo de Heredia. Se ordena a Ligia Umaña Ledezma en su condición de Jueza Titular de Tribunal Ambiental Administrativo y como Jueza Tramitadora de los expedientes finalizados en 02-TAA , o a quien en su lugar ejerza ese cargo, que realice las actuaciones necesarias para que se resuelva el expediente n.° 410-09-02-TAA como en derecho corresponda y se notifique lo resuelto a la parte amparada, todo en un plazo no mayor a 2 meses, contado a partir de la audiencia que se efectuará el 1 de setiembre de 2020. Asimismo, se ordena a Pedro González Morera en su condición de Viceministro de Salud o a quien en su lugar ejerza ese cargo, que realice las actuaciones necesarias, a fin de dar seguimiento a la resolución 001252-F-S1-2020 (…)".”

II. SOBRE LA PRIMERA GESTIÓN DE INEJECUCIÓN

Mediante sentencia interlocutoria No.2021007879 de las 9:40 horas del 20 de abril de 2021, este Tribunal constató la desobediencia acusada por la parte recurrente, y resolvió:

“II.- SOBRE LA GESTIÓN PLANTEADA. La parte recurrente, acusa que no se ha cumplido con lo ordenado por este Tribunal en la Sentencia supra citada. Ahora bien, dado que de la constancia emitida por el Técnico Judicial y el Secretario de esta Sala el 09 de abril de 2021, se desprende que la autoridad recurrida no rindió el informe que le fue requerido con respecto al supuesto incumplimiento de lo dispuesto en la Sentencia antes mencionada, en aplicación de lo dispuesto por el artículo 45, de la Ley de la Jurisdicción Constitucional, esta Sala debe tener por ciertos los hechos alegados por el recurrente, y, por ende, debe acoger la gestión de desobediencia planteada, con las consecuencias que se dirán en la parte dispositiva.

POR TANTO:

Se reitera a Ligia Umaña Ledezma en su condición de Jueza Titular de Tribunal Ambiental Administrativo y como Jueza Tramitadora de los expedientes finalizados en 02-TAA, o a quien ocupe su cargo, el cumplimiento de lo dispuesto en la Sentencia N° 2020-017177 de las 09:20 horas del 11 de septiembre de 2020, bajo la advertencia de ordenar el testimonio de piezas ante el Ministerio Público por el delito previsto en el artículo 71, de la Ley de la Jurisdicción Constitucional. Notifíquese esta Sentencia a la recurrida, en forma personal.”

III. SOBRE LA GESTIÓN PLANTEADA

En la especie, el recurrente plantea una gestión de desobediencia en relación con la sentencia N° 2020-017177 de las 09:20 horas del 11 de septiembre de 2020, en la que se ordenó resolver el expediente n.° 410-09-02-TAA como en derecho corresponda y se notifique lo resuelto a la parte amparada, en el plazo no mayor a dos meses. Si bien, del informe rendido bajo juramento la autoridad recurrida indica que ha realizado múltiples gestiones en la tramitación del expediente, lo que retrasó el dictado del acto final, lo cierto es que ha transcurrido casi un año desde que se ordenó que se resolviera la denuncia, por lo que resulta improcedente a estas alturas tal justificación. En mérito de las consideraciones expuestas lo procedente es acoger la gestión planteada.

IV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se acoge la gestión formulada. Se le ordena a Elizabeth Araya Jiménez en su condición de Jueza Titular de Tribunal Ambiental Administrativo y como Jueza Tramitadora de los expedientes finalizados en 02-TAA, o a quien ocupe su cargo, el cumplimiento de lo dispuesto en la Sentencia N° 2020-017177 de las 09:20 horas del 11 de septiembre de 2020, bajo la advertencia de ordenar el testimonio de piezas ante el Ministerio Público por el delito previsto en el artículo 71, de la Ley de la Jurisdicción Constitucional. Notifíquese.
