 Recurso de amparo processed in expediente number 21-014370-0007-CO, filed by RAYMOND ALEJANDRO BARBOZA GUZMAN, identity card 0111670568, of legal age, against the OFICINA DE RECURSOS HUMANOS DEL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC).

Resultando:

 1.- By written submission received in the Secretariat of the Chamber on 27 July 2021, the appellant files a recurso de amparo against the Human Resources Office of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC). He states that, as of 1 July 2021, he appeared at the offices of the National System of Conservation Areas (SINAC), specifically in the Human Resources Office, and delivered a letter requesting: "information on the results of the competitions held in different years, by this servant: The Civil Service through official letter ARSP-UPCCER-0008-2021. Dated twelve of the fifth of two thousand twenty-one. I am notified of the result of a competition held in the year 2011, competition No. NE-001-2011 in which I am assigned. JOB CLASS: Civil Service Professional A (G. de E) SPECIALTY: Environmental Protection and Management of Conservation Areas, /without sub-Specialty. I was assigned the grade: 84.547. SECOND: In the month of September 2019, I participated in the competition for the Osa Conservation Area (ACOSA) Without specifying the position to be filled. THIRD: On 31 January 2020, I participated in the competition, for Civil Service Technician 3, Specialty: Environmental Protection and Management of Conservation Areas, La Amistad-Pacifico Conservation Area. (ACLAP) FOURTH: On 17 September 2020, I participated in the competition, vacancy 502156 Arenal Huetar Norte Conservation Area. (ACAHN)". He indicates that as of the date of filing this recurso, he has not received any response, which he considers a violation of his fundamental rights.

 2.- By Presidency resolution at 10:23 hours on 28 July 2021, the amparo was processed and a hearing was granted to the Director of the Human Resources Office of the National System of Conservation Areas (SINAC).

 3.- By written submission added to the Electronic Management System of this Office, Franny Catalina Centeno Esquivel, Acting Chief of the Human Resources Department of the National System of Conservation Areas, renders a report under oath. She indicates that "...FIRST: I cannot attest to what the appellant indicated because the information on the eligibility or suitability of the offerors before the Dirección General del Servicio Civil is of a personal nature and is not provided to the Human Resources Departments of State institutions. Notwithstanding the foregoing, according to the documents delivered by Mr. Barboza Guzmán Raymond, specifically official letter ARSP-UPC-CER-0008 of 12 May 2021, this Department of Institutional Management of Human Resources is aware that Mr. Barboza Guzmán is eligible on the list of external candidates of the Dirección General del Servicio Civil for the job class Civil Service Professional 1-A, specialty: Environmental Protection and Management of Conservation Areas, with a grade of 84, 549, position 118. SECOND: Effectively, through official letter SINAC-ACOSA-ORDRH-C-135 of 13 July 2021, signed by Ms. Herra Bonilla Marta Elena, Human Resources Coordinator of the Osa Conservation Area, she indicates that the job posting for position 60824505634 (currently 381612), classified as Civil Service Technician 1, specialty: Environmental Protection and Management of Conservation Areas, assigned to Golfo Dulce Reserve, Puntarenas, Golfito, Jiménez, was published on 19 July 2019, with a closing date for receiving offers on 25 July 2019. THIRD: In this regard, the Regional Human Resources Managers of the Osa Conservation Area informed the Administrator of the Protected Wilderness Area, at that time Mr. Juan José Jiménez Espinoza, that he must make a selection from the pre-selected curriculum vitae that meet the requirements of the position in question, a procedure they confirm on 8 August 2019 via institutional email, because they sent Mr. Jiménez Espinoza an interview guide and asked him to coordinate dates for the interviews, since, at that time, according to the procedure of the Ministry of Environment and Energy, approval and accompaniment to interviews had to be requested from the Minister's office. However, Mr. Jiménez Espinoza did not inform the Regional Human Resources Office of Osa of the possible interview dates. Faced with this situation, the colleagues, Regional Human Resources Managers of the Osa Conservation Area, reminded Mr. Jiménez Espinoza, both by email and verbally, that he had to resolve the recruitment for the position resulting from the job posting that had been circulated in August 2019. FOURTH: With the entry into force of Decreto Ejecutivo 9879 'Second Extraordinary Budget of the Republic for the 2020 Fiscal Year and Second Legislative Modification of Ley 9791, Law of the Ordinary and Extraordinary Budget of the Republic for the 2020 Fiscal Year', regulation 12 indicates that only positions intended for park rangers (guardaparques) may be used. Subsequently, by December 2020, the Superintendencia de Autorización Presupuestaria granted approval for the use of vacant position No. 381612, since it was included among the positions with control and protection activities for park rangers. FIFTH: On 27 October 2020, payroll No. 00333-2020 was received from the Dirección General del Servicio Civil, composed of a single candidate, who, once the interview was conducted, did not accept, due to the conditions of the position and its salary conditions, for which reason the Recruitment and Selection Area of the DGSC was informed that the payroll was unresolved. SIXTH: According to what is indicated in official letter DG-003-2015, we are authorized to make an interim appointment, for which two offerors were interviewed: a-. Mr. Carlos Murillo Guadamuz and b-. Mr. Jeison Céspedes Vindas. Subsequently, with official letter SINAC-ACOSA-DAP-044 of 2020, Mr. Juan José Jiménez Espinoza reports that Mr. Jeyson Céspedes Vindas was chosen for the interim appointment, for which the appointment proposal was made effective 1 December 2020, and Mr. Céspedes Vindas is the interim official in ACOSA to date. SEVENTH: Notwithstanding what was stated by the appellant, according to information received by email on 12 July 2021, signed by Ms. Esther Díaz Caballero, Regional Manager of the Amistad Pacífico Conservation Area (ACLA-P), there is no record of a curriculum vitae from Mr. Barboza Guzmán for the year 2020, for which reason I cannot issue an opinion or pronounce on this matter. It should be noted that the National System of Conservation Areas has 1154 positions in its list, of which 138 have the classification of Civil Service Technician 3, making it difficult for the Department of Institutional Management of Human Resources to determine the process if the number of the position for which the recruitment was conducted is not indicated. In accordance with the legal requirements established for the Class Manual of the Dirección General del Servicio Civil, Civil Service Technicians 3 require an up-to-date weapon-carrying permit (carné de portar armas), as specified in the job posting; furthermore, the pre-selection process carried out by the Regional Human Resources Offices is in full compliance with what is stated in each posting. Thus, for the candidate to be pre-selected for an interview, they must fully meet both the technical requirements of the class and the legal requirements. It is also important to note that the only vacant position for the Amistad Pacífico Conservation Area (ACLA-P) with the classification of Civil Service Technician 3, specialty: Environmental Protection and Management of Conservation Areas, was No. 381703 (formerly 2754050523), which, as indicated in subsection d of official letter DM-897-2020 was eliminated from the List of Positions of the National System of Conservation Areas as of 30 July 2020. EIGHTH: Similarly, as stated in official letter SINAC-ACAHN-ORDRH-156 of 12 July 2021, signed by Ms. Patricia Ramírez Hernández, Regional Human Resources Manager of the Huetar Norte Conservation Area, it is indicated that position No. 502156 classified as Civil Service Technician 1, specialty: Environmental Protection and Management of Conservation Areas, is assigned to Parque Nacional Volcán Arenal. She also indicates that the Huetar Norte Conservation Area received a curriculum vitae from Mr. Barboza Guzmán on 17 September 2020 and according to the legal requirements established for the Class Manual of the Dirección General del Servicio Civil, noting that Civil Service Technicians 3 require an up-to-date weapon-carrying permit, as specified in the job posting; additionally. Thus, for the candidate to be pre-selected for an interview, they must fully meet both the requirements of the class and the legal requirements, and although it is true that in the curriculum vitae provided by Mr. Barboza Guzmán, he indicates that he has an A2 license, he does not indicate if he has a weapon-carrying permit, or any proceeding in process to obtain one, this being one of the established requirements for Civil Service Technician 1-2-3 positions that are assigned control and protection functions, as is the case for position No. 502156. Given the circumstances, on 21 September 2020, Mr. Michael Rodríguez, Mr. Fausto Alfaro, and Ms. Mariana Jiménez were informed that during the period from 15 to 18 September 2020, the same period established by the published job posting, 51 curriculum vitae were received, detailed as follows: • 20 curriculum vitae that do not indicate any proceeding for weapon carrying, or a vehicle driver's license, among which is the one submitted by Mr. Barboza Guzmán. • 19 curriculum vitae corresponding to other specialties different from Environmental Protection and Management of Conservation Areas. • 12 curriculum vitae relevant to the specialty of the position, having vehicle driver's licenses and Management of Conservation Areas. NINTH: Subsequently, on 28 September 2020, the 12 candidates who submitted their curriculum vitae and that were relevant to the specialty of the position, who had vehicle driver's licenses, and also had documents demonstrating some proceeding to obtain permits for weapon carrying (detail attached) were summoned to interviews, with Ms. Zúñiga Torres María Andreina being selected, who obtained the best score in the interview conducted. As the Magistrates can observe, Mr. Barboza Guzmán's request has been addressed. Unfortunately, the information he requested was not in the central offices of this Department, but had to be requested and verified from 3 different Conservation Areas, which delayed its timely and proper attention. Notwithstanding the foregoing, this procedure allowed us to determine that the appellant was not eligible in any of the 3 competitions for which he requested information, basically because he did not have the Weapon-Carrying Permit (Carnet de Portación de Armas) nor had he demonstrated that he was undertaking the procedure to obtain it...".

 4.- By resolution at 09:37 hours on 12 August 2021, the Acting Chief of the Human Resources Department of the National System of Conservation Areas was requested to provide evidence to better resolve.

 5.- By official letter provided on 13 August 2021, Franny Catalina Centeno Esquivel, Acting Chief of the Human Resources Department of the National System of Conservation Areas, appears before this Chamber for the purpose of providing a copy of official letter SINAC-SE-DGIRH-0624-2021.

 6.- The legal requirements have been observed in the proceedings followed.

 Drafted by Magistrate Picado Brenes; and,

Considerando:

 I.- Object of the recurso. The appellant considers his fundamental rights violated. He states that, as of 1 July 2021, he appeared at the offices of the National System of Conservation Areas (SINAC), requesting in writing information of his interest, specifically "...information on the results of the competitions held in different years, by this servant: The Civil Service through official letter ARSP-UPCCER-0008-2021. Dated twelve of the fifth of two thousand twenty-one. I am notified of the result of a competition held in the year 2011, competition No. NE-001-2011 in which I am assigned. JOB CLASS: Civil Service Professional A (G. de E) SPECIALTY: Environmental Protection and Management of Conservation Areas, /without sub-Specialty. I was assigned the grade: 84.547. SECOND: In the month of September 2019, I participated in the competition for the Osa Conservation Area (ACOSA) Without specifying the position to be filled. THIRD: On 31 January 2020, I participated in the competition, for Civil Service Technician 3, Specialty: Environmental Protection and Management of Conservation Areas, La Amistad-Pacifico Conservation Area. (ACLAP) FOURTH: On 17 September 2020, I participated in the competition, vacancy 502156 Arenal Huetar Norte Conservation Area. (ACAHN)". He claims that, as of the date of filing the recurso, he has not received a response to his request.

 II.- Proven facts. Of importance for the decision in this matter, the following facts are considered duly proven, either because they have been accredited or because the respondent has omitted to refer to them, as provided in the initial order:

The appellant, Barboza Guzmán, is eligible on the list of external candidates of the Dirección General del Servicio Civil for the job class Civil Service Professional 1-A, specialty: Environmental Protection and Management of Conservation Areas, with a grade of 84, 549, position 118. (See report rendered under oath) On 1 July 2021, the appellant appeared at the offices of the National System of Conservation Areas (SINAC), requesting in writing information of his interest, specifically "...information on the results of the competitions held in different years, by this servant: The Civil Service through official letter ARSP-UPCCER-0008-2021. Dated twelve of the fifth of two thousand twenty-one. I am notified of the result of a competition held in the year 2011, competition No. NE-001-2011 in which I am assigned. JOB CLASS: Civil Service Professional A (G. de E) SPECIALTY: Environmental Protection and Management of Conservation Areas, /without sub-Specialty. I was assigned the grade: 84.547. SECOND: In the month of September 2019, I participated in the competition for the Osa Conservation Area (ACOSA) Without specifying the position to be filled. THIRD: On 31 January 2020, I participated in the competition, for Civil Service Technician 3, Specialty: Environmental Protection and Management of Conservation Areas, La Amistad-Pacifico Conservation Area. (ACLAP) FOURTH: On 17 September 2020, I participated in the competition, vacancy 502156 Arenal Huetar Norte Conservation Area. (ACAHN)". (See evidence provided) The job posting for position 60824505634 (currently 381612), classified as Civil Service Technician 1, specialty: Environmental Protection and Management of Conservation Areas, assigned to Golfo Dulce Reserve, Puntarenas, Golfito, Jiménez, was published on 19 July 2019, with a closing date for receiving offers on 25 July 2019...". (See report rendered under oath) Through official letter No. SINAC-SE-DGIRH-0624-2021, of 5 August 2021, signed by Hannia Rita Obando Razak, Legal Advisor of the Department of Institutional Management of Human Resources of the National System of Conservation Areas, the response to be provided to the protected party was prepared. (See report rendered under oath and documentation provided) As of the date of filing the recurso de amparo -27 July 2021- the appellant had not received a response to his request. (The Orders)  III.- Unproven fact. The following fact is not considered duly accredited:

Single. That the response official letter No. SINAC-SE-DGIRH-0624-2021, of 5 August 2021, signed by Hannia Rita Obando Razak, Legal Advisor of the Department of Institutional Management of Human Resources of the National System of Conservation Areas, was communicated to the means indicated by the appellant. (Lacking evidence)  IV.- On the specific case. In the sub lite, the appellant complains that he has participated in several competitions to obtain a position in the offices of the National System of Conservation Areas (SINAC); however, he claims that he does not know the outcome of the competitions; this, despite having repeatedly requested the respective information.

 In this regard, after analyzing the evidentiary elements provided, this Court finds a violation of the fundamental rights of the protected party. This is because, in the report rendered by the representatives of the respondent authority—which is considered given under oath with the consequences, even criminal, provided in Article 44 of the Law that governs this Jurisdiction—and the evidence provided for the resolution of the matter, it has been duly accredited that the appellant, Barboza Guzmán, is eligible on the list of external candidates of the Dirección General del Servicio Civil for the job class Civil Service Professional 1-A, specialty: Environmental Protection and Management of Conservation Areas, with a grade of 84, 549, position 118. Furthermore, on 1 July 2021, the appellant appeared at the offices of the National System of Conservation Areas (SINAC), requesting in writing information of his interest, specifically "...information on the results of the competitions held in different years, by this servant: The Civil Service through official letter ARSP-UPCCER-0008-2021. Dated twelve of the fifth of two thousand twenty-one. I am notified of the result of a competition held in the year 2011, competition No. NE-001-2011 in which I am assigned. JOB CLASS: Civil Service Professional A (G. de E) SPECIALTY: Environmental Protection and Management of Conservation Areas, /without sub-Specialty. I was assigned the grade: 84.547. SECOND: In the month of September 2019, I participated in the competition for the Osa Conservation Area (ACOSA) Without specifying the position to be filled. THIRD: On 31 January 2020, I participated in the competition, for Civil Service Technician 3, Specialty: Environmental Protection and Management of Conservation Areas, La Amistad-Pacifico Conservation Area. (ACLAP) FOURTH: On 17 September 2020, I participated in the competition, vacancy 502156 Arenal Huetar Norte Conservation Area. (ACAHN)". Added to the above, the job posting for position 60824505634 (currently 381612), classified as Civil Service Technician 1, specialty: Environmental Protection and Management of Conservation Areas, assigned to Golfo Dulce Reserve, Puntarenas, Golfito, Jiménez, was published on 19 July 2019, with a closing date for receiving offers on 25 July 2019. Through official letter No. SINAC-SE-DGIRH-0624-2021, of 5 August 2021, signed by Hannia Rita Obando Razak, Legal Advisor of the Department of Institutional Management of Human Resources of the National System of Conservation Areas, the response to be provided to the protected party was prepared. As of the date of filing the recurso de amparo -27 July 2021- the appellant had not received a response to his request. Finally, it was not possible to prove that the response official letter No. SINAC-SE-DGIRH-0624-2021, of 5 August 2021, signed by Hannia Rita Obando Razak, Legal Advisor of the Department of Institutional Management of Human Resources of the National System of Conservation Areas, was communicated to the means indicated by the appellant.

 From the factual picture described, this Court finds a violation of the fundamental rights of the protected party. Note that the respondent authority acknowledges that the information was not in the central offices and that for this reason his request was not addressed in a timely and proper manner. On the other hand, they reported that, through official letter No. SINAC-SE-DGIRH-0624-2021, of 5 August 2021, signed by Hannia Rita Obando Razak, Legal Advisor of the Department of Institutional Management of Human Resources of the National System of Conservation Areas, a response was provided to the appellant; however, there is no proof of having sent the response to the means indicated by the appellant. By virtue of the foregoing, the recurso must be declared with merit, with the consequences that will be stated in the operative part of this judgment.

 V.- Documentation provided to the expediente. The parties are warned that if they have provided any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or one produced by new technologies, these must be withdrawn from the office within a maximum period of 30 working days counted from the notification of this judgment. Otherwise, all material that is not withdrawn within this period will be destroyed, as provided in the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in session No. 27-11 of 22 August 2011, Article XXVI and published in the Judicial Bulletin number 19 of 26 January 2012, as well as in the agreement approved by the Consejo Superior del Poder Judicial, in session No. 43-12 held on 3 May 2012, Article LXXXI.

POR TANTO:

The recurso is declared with merit. Franny Catalina Centeno Esquivel, Acting Chief of the Human Resources Department of the National System of Conservation Areas, or whoever holds the position in her place, is ordered to issue the pertinent orders so that, within a period of 3 DAYS counted from the notification of this judgment, the response official letter to his request, No. SINAC-SE-DGIRH-0624-2021, of 5 August 2021, signed by Hannia Rita Obando Razak, Legal Advisor of the Department of Institutional Management of Human Resources of the National System of Conservation Areas, is communicated to the means indicated by the appellant RAYMOND ALEJANDRO BARBOZA GUZMÁN, identity card No. 111670568. The foregoing is ordered with the warning that, should he fail to comply with this order, he will incur the crime of disobedience and, in accordance with Article 71 of the Law of this Jurisdiction, a prison sentence of three months to two years, or a fine of twenty to sixty days, shall be imposed on anyone who receives an order that must be complied with or enforced, issued in a recurso de amparo, and does not comply with it or enforce it, provided that the crime is not more severely punished. The State is ordered to pay costs, damages, and losses caused by the facts that serve as the basis for this declaration, which will be settled in the execution of the sentence in the contentious-administrative jurisdiction. Sala Constitucional Clase de asunto: Recurso de amparo Analizado por: SALA CONSTITUCIONAL  Res. Nº 2021018508 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veinte de agosto de dos mil veintiuno .

Recurso de amparo que se tramita en expediente número 21-014370-0007-CO, interpuesto por RAYMOND ALEJANDRO BARBOZA GUZMAN, cédula de identidad 0111670568, mayor, contra la OFICINA DE RECURSOS HUMANOS DEL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC).

Resultando:

1.- Por escrito recibido en la Secretaría de la Sala el 27 de julio de 2021, el recurrente interpone recurso de amparo contra la Oficina de Recursos Humanos del Sistema Nacional de Áreas de Conservación (SINAC). Manifiesta que, desde el 1° de julio de 2021 se apersonó en las oficinas del Sistema Nacional de Áreas de Conservación (SINAC), específicamente en la Oficina de Recursos Humanos, y entregó una carta solicitando: "información sobre los resultados de los concursos realizados en diferentes años, por este servidor: El Servicio Civil mediante Oficio ARSP-UPCCER-0008-2021. Con fecha doce del cinco del dos mil veintiuno. Se me notifica el resultado de concurso realizado en el año 2011, concurso N° NE-001-2011 en el cual se me asigna. CLASE DE PUESTO: Profesional de Servicio Civil A (G. de E) ESPECIALIDAD: Protección Ambiental y Manejo de Áreas de Conservación, /sin sub-Especialidad. Se me asigno la nota: 84.547. SEGUNDO: En el mes de setiembre del 2019, participé en el concurso para el Área de Conservación Osa (ACOSA) Sin precisar el puesto por ocupar. TERCERO: El día 31 de enero del 2020, participe en el concurso, para Técnico en Servicio Civil 3, Especialidad: Protección Ambiental y Manejo de Áreas de Conservación, Área de Conservación La Amistad-Pacifico. (ACLAP) CUARTO: El día 17 de setiembre del 2020, participe en el concurso, vacante 502156 Área de Conservación Arenal Huetar Norte. (ACAHN)". Indica que al día de interposición de este recurso, no ha recibido respuesta alguna, lo que estima violatorio de sus derechos fundamentales.

2.- Mediante resolución de Presidencia de las 10:23 horas del 28 de julio de 2021, se dio curso al amparo y se confirió audiencia al Director de la Oficina de Recursos Humanos del Sistema Nacional de Áreas de Conservación (SINAC) 3.- Mediante escrito agregado al Sistema Electrónico de Gestión de este Despacho, rinde informe bajo fe de juramento, Franny Catalina Centeno Esquivel, Jefe a.i. del Departamento de Recursos Humanos del Sistema Nacional de Áreas de Conservación. Indica que “…PRIMERO: No me consta lo indicado por el recurrente por cuanto la información de la elegibilidad o idoneidad de los oferentes ante la Dirección General del Servicio Civil, es de carácter personal y no se brinda a los Departamentos Recursos Humanos de las instituciones del Estado. No obstante lo anterior, conforme los documentos entregados por el señor Barboza Guzmán Raymond, específicamente el oficio ARSP-UPC-CER-0008 del 12 de mayo del 2021, este Departamento de Gestión Institucional de Recursos Humanos, tiene conocimiento que el señor Barboza Guzmán se encuentra elegible en la lista de candidatos externos de la Dirección General del Servicio Civil para la clase de puesto Profesional del Servicio Civil 1-A, especialidad: Protección Ambiental y Manejo de Áreas de Conservación, con una nota de 84, 549, posición 118. SEGUNDO: Efectivamente mediante oficio SINAC-ACOSA-ORDRH-C-135 del 13 de julio 2021, suscrito por la señora Herra Bonilla Marta Elena, Coordinadora de Recursos Humanos de Área de Conservación Osa, indica que el cartel del puesto 60824505634 (actualmente 381612), clasificado como Técnico del Servicio Civil 1, especialidad: Protección Ambiental y Manejo de Áreas de Conservación, destacado en Reserva Golfo Dulce, Puntarenas, Golfito, Jiménez, se publicó el 19 de julio 2019, con cierre de recepción de ofertas el 25 de julio de 2019. TERCERO : Al respecto, las Encargadas Regionales de Recursos Humanos del Área de Conservación Osa informan al Administrador del Área Silvestre Protegida, en ese entonces el señor Juan José Jiménez Espinoza, que debe realizar una selección de los curriculum vitae ya preseleccionados y que cumplen con los requisitos del puesto en cuestión, trámite que confirman en fecha 08 de agosto del 2019 mediante correo institucional, en razón que le remiten al señor Jiménez Espinoza, una guía para la entrevista y le solicitan coordinar fechas para las entrevistas, ya que, para ese momento, según procedimiento del Ministerio de Ambiente y Energía, se tenía que solicitar visto bueno y acompañamiento a entrevistas al despacho del Ministro. Sin embargo, el señor Jiménez Espinoza no informó a la Oficina Regional de Recursos Humanos de Osa las posibles fechas de entrevista. Ante tal panorama, las compañeras Encargadas Regionales de Recursos Humanos del Área de Conservación Osa, le recordaron a señor Jiménez Espinoza, tanto por correo electrónico como de forma verbal que debía resolver el reclutamiento del puesto producto del cartel que se había circulado en agosto del 2019. CUARTO : Con la entrada en vigencia del Decreto Ejecutivo 9879 “Segundo Presupuesto Extraordinario de la República para el ejercicio Económico del 2020 y Segunda Modificación Legislativa de la Ley 9791, Ley de Presupuesto Ordinario y Extraordinario de la República para el Ejercicio Económico 2020”, la norma 12 indica que únicamente los puestos destinados para guardaparques podrán ser utilizados. Posteriormente, para el mes de diciembre del 2020, la Superintendencia de Autorización Presupuestaria brinda el visto bueno para la utilización de la plaza vacante No. 381612, ya que fue incluida dentro de los puestos con actividades de control y protección para guardaparques. QUINTO : En fecha 27 de octubre del 2020, se recibe la nómina No. 00333-2020 de la Dirección General del Servicio Civil, conformada por un único candidato, el cual una vez realizada la entrevista no acepta, debido a las condiciones del puesto y las condiciones salariales del mismo, por lo que se comunica al Área de Reclutamiento y Selección de la DGSC que la nómina resulta irresoluta. SEXTO : Según lo indicado en el oficio DG-003-2015, se nos autoriza realizar un nombramiento interino, por lo cual se entrevistan a dos oferentes : a-. El señor Carlos Murillo Guadamuz y b-. El Señor Jeison Céspedes Vindas. Posteriormente, con oficio SINAC-ACOSA-DAP-044 del 2020, el señor Juan José Jiménez Espinoza, informa que se escoge para el nombramiento interino al señor Jeyson Céspedes Vindas, por lo que se realiza la propuesta de nombramiento a partir del 01 de diciembre del 2020, siendo hasta la fecha, el señor Céspedes Vindas funcionario interino en ACOSA. SETIMO: No obstante lo indicado por el recurrente, según información recibida por correo electrónico en fecha 12 de julio del 2021, suscrito por la señora Esther Díaz Caballero, Encargada Regional del Área de Conservación Amistad Pacífico (ACLA-P), no se tiene registro de curriculum vitae del señor Barboza Guzmán del año 2020., en razón de lo cual, no puedo emitir criterio ni pronunciarme sobre dicho tema. Cabe señalar que el Sistema Nacional de Áreas de Conservación tiene en su relación de puestos 1154 puestos, de los cuales 138 tiene la clasificación de Técnico del Servicio Civil 3, que para el Departamento de Gestión Institucional de Recursos Humanos es difícil determinar el proceso si no se indica el número de puesto para el cual fue objeto de reclutamiento. Conforme los requisitos legales establecidos para el Manual de Clases de la Dirección General del Servicio Civil, los Técnicos de Servicio Civil 3 requieren carné de portar armas al día, como se especifica en el cartel; además, que el proceso de pre-selección que se realiza las Oficinas Regionales de Recursos Humanos está en pleno apego a lo mencionado en cada cartel. Siendo así, que para que el candidato esté pre-seleccionado para entrevista debe cumplir a cabalidad, tanto con los requisitos a nivel técnico de la clase, así como con los requisitos legales. También es importante señalar que el único puesto vacante para el Área de Conservación Amistad Pacífico 8ACLA-P) con la clasificación de Técnico del Servicio Civil 3, especialidad: Protección Ambiental y Manejo de Áreas de Conservación, fue el No.381703 (antes 2754050523), el cual conforme lo indicado en el inciso d del oficio DM-897 -2020 fue eliminado de la Relación de Puestos del Sistema Nacional de Áreas de Conservación al 30 de julio del 2020. OCTAVO: De igual forma, según lo señalado en el oficio SINAC-ACAHN-ORDRH-156 del 12 de julio del 2021, suscrito por la señora Patricia Ramírez Hernández, Encargada Regional de Recursos Humanos del Área de Conservación Huetar Norte se indica que el puesto No. 502156 clasificado como Técnico del Servicio Civil 1, especialidad: Protección Ambiental y Manejo de Áreas de Conservación, esta destacado en el Parque Nacional Volcán Arenal. Indica además, que el Área de Conservación Huetar Norte recibió curriculum vitae del señor Barboza Guzmán el 17 de setiembre del 2020 y conforme los requisitos legales establecidos para el Manual de Clases de la Dirección General del Servicio Civil, siendo que los Técnicos de Servicio Civil 3 requieren carné de portar armas al día, como se especifica en el cartel; además. Siendo así, para que el candidato este pre-seleccionado para entrevista debe cumplir a cabalidad con tanto con los requisitos de la clase como los legales y si bien es cierto, en el curriculum vitae aportado por el señor Barboza Guzmán, indica que posee licencia A2, no indica si cuenta con carné de portación de armas, o algún trámite en proceso de obtención, siendo este uno de los requisitos establecidos para los puestos de Técnico de Servicio Civil 1-2-3, que se le asignen funciones de control y protección, tal es el caso de puesto No. 502156. Así las cosas, en fecha 21 de setiembre del 2020, se le comunicó a los señores Michael Rodríguez, Fausto Alfaro y Mariana Jiménez, que entre el periodo comprendido del 15 al 18 de setiembre del 2020, mismo que establecía el cartel publicado, se recibieron 51 curriculum vitae detallados de esta manera: • 20 curriculum vitae que no indican tener ningún trámite para portación de armas, o bien licencia para conducir vehículos, entre los cuales se tiene el que presentó el señor Barboza Guzmán. • 19 curriculum que corresponde con otras especialidades diferentes a Protección Ambiental y Manejo de Áreas de Conservación. • 12 curriculum atinentes a la especialidad del puesto, cuentan con licencias de conducir vehículos y Manejo de Áreas de Conservación. NOVENO : Posteriormente, para el día 28 de setiembre del 2020 se convocó a entrevistas a los 12 candidatos que aportaron su curriculum y que eran atinentes con la especialidad del puesto, que contaban con licencias de conducir vehículos y además con documentos que demostraran algún trámite para conseguir los permisos para la portación de armas (se adjunta detalle), siendo seleccionada la señora Zúñiga Torres María Andreina, quien fue la que obtuvo mejor puntuación en la entrevista realizada Como podrán observar los Señores Magistrados, se ha atendido la gestión del Señor Barboza Guzmán. Lamentablemente, la información que solicitaba no se encontraba en las oficinas centrales de éste Departamento, sino se tenía que solicitar y verificar a 3 Áreas de Conservación diferentes lo que atrasó que se atendiera en tiempo y forma. No obstante lo anterior, dicho trámite nos permitió determinar que el recurrente no estaba elegible en ninguno de los 3 concursos cuya información solicito, básicamente por no tener el Carnet de Portación de Armas ni haber demostrado que estuviera realizando el trámite para la obtención del mismo…”.

4.- Mediante resolución de la 09:37 horas del 12 de agosto de 2021, se solicitó al Jefe a.i. del Departamento de Recursos Humanos del Sistema Nacional de Áreas de Conservación, prueba para mejor resolver.

5.- Por oficio aportado el 13 de agosto de 2021, Franny Catalina Centeno Esquivel, Jefe a.i. del Departamento de Recursos Humanos del Sistema Nacional de Áreas de Conservación, se apersona ante esta Sala con la finalidad de aportar copia del oficio SINAC-SE-DGIRH-0624-2021.

6.- En los procedimientos seguidos se han observado las prescripciones legales.

Redacta la Magistrada Picado Brenes; y,

Considerando:

I.- Objeto del recurso. El recurrente estima lesionados sus derechos fundamentales. Refiere que, desde el 1° de julio de 2021, se apersonó en las oficinas del Sistema Nacional de Áreas de Conservación (SINAC), solicitando por escrito, información de su interés, en concreto “…información sobre los resultados de los concursos realizados en diferentes años, por este servidor: El Servicio Civil mediante Oficio ARSP-UPCCER-0008-2021. Con fecha doce del cinco del dos mil veintiuno. Se me notifica el resultado de concurso realizado en el año 2011, concurso N° NE-001-2011 en el cual se me asigna. CLASE DE PUESTO: Profesional de Servicio Civil A (G. de E) ESPECIALIDAD: Protección Ambiental y Manejo de Áreas de Conservación, /sin sub-Especialidad. Se me asigno la nota: 84.547. SEGUNDO: En el mes de setiembre del 2019, participé en el concurso para el Área de Conservación Osa (ACOSA) Sin precisar el puesto por ocupar. TERCERO: El día 31 de enero del 2020, participe en el concurso, para Técnico en Servicio Civil 3, Especialidad: Protección Ambiental y Manejo de Áreas de Conservación, Área de Conservación La Amistad-Pacifico. (ACLAP) CUARTO: El día 17 de setiembre del 2020, participe en el concurso, vacante 502156 Área de Conservación Arenal Huetar Norte. (ACAHN)". Acusa que, a la fecha de interposición del recurso, no ha recibido respuesta a su gestión.

II.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:

El recurrente, Barboza Guzmán se encuentra elegible en la lista de candidatos externos de la Dirección General del Servicio Civil para la clase de puesto Profesional del Servicio Civil 1-A, especialidad: Protección Ambiental y Manejo de Áreas de Conservación, con una nota de 84, 549, posición 118. (Ver informe rendido bajo fe de juramento) El 1° de julio de 2021, el recurrente se apersonó en las oficinas del Sistema Nacional de Áreas de Conservación (SINAC), solicitando por escrito, información de su interés, en concreto “…información sobre los resultados de los concursos realizados en diferentes años, por este servidor: El Servicio Civil mediante Oficio ARSP-UPCCER-0008-2021. Con fecha doce del cinco del dos mil veintiuno. Se me notifica el resultado de concurso realizado en el año 2011, concurso N° NE-001-2011 en el cual se me asigna. CLASE DE PUESTO: Profesional de Servicio Civil A (G. de E) ESPECIALIDAD: Protección Ambiental y Manejo de Áreas de Conservación, /sin sub-Especialidad. Se me asigno la nota: 84.547. SEGUNDO: En el mes de setiembre del 2019, participé en el concurso para el Área de Conservación Osa (ACOSA) Sin precisar el puesto por ocupar. TERCERO: El día 31 de enero del 2020, participe en el concurso, para Técnico en Servicio Civil 3, Especialidad: Protección Ambiental y Manejo de Áreas de Conservación, Área de Conservación La Amistad-Pacifico. (ACLAP) CUARTO: El día 17 de setiembre del 2020, participe en el concurso, vacante 502156 Área de Conservación Arenal Huetar Norte. (ACAHN)". (Ver prueba aportada) El cartel del puesto 60824505634 (actualmente 381612), clasificado como Técnico del Servicio Civil 1, especialidad: Protección Ambiental y Manejo de Áreas de Conservación, destacado en Reserva Golfo Dulce, Puntarenas, Golfito, Jiménez, se publicó el 19 de julio 2019, con cierre de recepción de ofertas el 25 de julio de 2019…”. (Ver informe rendido bajo fe de juramento) Mediante el oficio No. SINAC-SE-DGIRH-0624-2021, del 05 de agosto de 2021, suscrito por Hannia Rita Obando Razak, Asesora Legal del Departamento de Gestión Institucional de Recursos Humanos del Sistema Nacional de Áreas de Conservación, se confeccionó la respuesta para brindar al amparado. (Ver informe rendido bajo fe de juramento y documentación aportada) A la fecha de interposición del recurso de amparo -27 de julio de 2021- el recurrente no había recibido respuesta a su gestión. (Los Autos) III.- Hecho no probado. No se estima como debidamente acreditado el siguiente hecho:

Único. Que el oficio de respuesta No. SINAC-SE-DGIRH-0624-2021, del 05 de agosto de 2021, suscrito por Hannia Rita Obando Razak, Asesora Legal del Departamento de Gestión Institucional de Recursos Humanos del Sistema Nacional de Áreas de Conservación, haya sido comunicado al medio señalado por el recurrente. (Ayuno de prueba) IV.- Sobre el caso concreto. En el sub lite, el recurrente reclama que, ha participado en varios concursos para obtener una plaza en las oficinas del Sistema Nacional de Áreas de Conservación (SINAC) no obstante, alega que, desconoce el resultado de los concursos; lo anterior, a pesar de haber solicitado en reiteradas ocasiones la información respectiva.

Al respecto, después de analizar los elementos probatorios aportados, este Tribunal acredita la lesión a los derechos fundamentales de la amparada. Lo anterior, porque en el informe rendido por los representantes de la autoridad recurrida -que se tiene por dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, ha sido debidamente acreditado que, el recurrente, Barboza Guzmán se encuentra elegible en la lista de candidatos externos de la Dirección General del Servicio Civil para la clase de puesto Profesional del Servicio Civil 1-A, especialidad: Protección Ambiental y Manejo de Áreas de Conservación, con una nota de 84, 549, posición 118. Además que, 1° de julio de 2021, el recurrente se apersonó en las oficinas del Sistema Nacional de Áreas de Conservación (SINAC), solicitando por escrito, información de su interés, en concreto “…información sobre los resultados de los concursos realizados en diferentes años, por este servidor: El Servicio Civil mediante Oficio ARSP-UPCCER-0008-2021. Con fecha doce del cinco del dos mil veintiuno. Se me notifica el resultado de concurso realizado en el año 2011, concurso N° NE-001-2011 en el cual se me asigna. CLASE DE PUESTO: Profesional de Servicio Civil A (G. de E) ESPECIALIDAD: Protección Ambiental y Manejo de Áreas de Conservación, /sin sub-Especialidad. Se me asigno la nota: 84.547. SEGUNDO: En el mes de setiembre del 2019, participé en el concurso para el Área de Conservación Osa (ACOSA) Sin precisar el puesto por ocupar. TERCERO: El día 31 de enero del 2020, participe en el concurso, para Técnico en Servicio Civil 3, Especialidad: Protección Ambiental y Manejo de Áreas de Conservación, Área de Conservación La Amistad-Pacifico. (ACLAP) CUARTO: El día 17 de setiembre del 2020, participe en el concurso, vacante 502156 Área de Conservación Arenal Huetar Norte. (ACAHN)". Aunado a lo anterior que, cartel del puesto 60824505634 (actualmente 381612), clasificado como Técnico del Servicio Civil 1, especialidad: Protección Ambiental y Manejo de Áreas de Conservación, destacado en Reserva Golfo Dulce, Puntarenas, Golfito, Jiménez, se publicó el 19 de julio 2019, con cierre de recepción de ofertas el 25 de julio de 2019. Mediante el oficio No. SINAC-SE-DGIRH-0624-2021, del 05 de agosto de 2021, suscrito por Hannia Rita Obando Razak, Asesora Legal del Departamento de Gestión Institucional de Recursos Humanos del Sistema Nacional de Áreas de Conservación, se confeccionó la respuesta para brindar al amparado. A la fecha de interposición del recurso de amparo -27 de julio de 2021- el recurrente no había recibido respuesta a su gestión. Finalmente, no se logró acredita que, el oficio de respuesta No. SINAC-SE-DGIRH-0624-2021, del 05 de agosto de 2021, suscrito por Hannia Rita Obando Razak, Asesora Legal del Departamento de Gestión Institucional de Recursos Humanos del Sistema Nacional de Áreas de Conservación, haya sido comunicado al medio señalado por el recurrente.

Del cuadro fáctico descrito, este Tribunal acredita la lesión a los derechos fundamentales del amparado. Nótese que, la autoridad recurrida reconoce que la información no estaba en las oficinas centrales y que por tal razón no se atendió en tiempo y forma su requerimiento. Por otra parte, informaron que, mediante el oficio No. SINAC-SE-DGIRH-0624-2021, del 05 de agosto de 2021, suscrito por Hannia Rita Obando Razak, Asesora Legal del Departamento de Gestión Institucional de Recursos Humanos del Sistema Nacional de Áreas de Conservación, se brindó respuesta a la parte recurrente; no obstante, no consta la prueba de haber remitido la respuesta al medio señalado por el recurrente. En virtud de lo expuesto, se debe declarar con lugar el recurso, con las consecuencias que se dirán en la parte dispositiva de esta sentencia.

V.- Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara con lugar el recurso. Se ordena a Franny Catalina Centeno Esquivel, Jefe a.i. del Departamento de Recursos Humanos del Sistema Nacional de Áreas de Conservación, o a quien en su lugar ocupe el puesto, que gire las órdenes pertinentes para que, dentro del plazo de 3 DÍAS contado a partir de la notificación de esta sentencia, se le comunique al medio señalado por el recurrente RAYMOND ALEJANDRO BARBOZA GUZMÁN, cédula de identidad No. 111670568, el oficio de respuesta a su gestión No. SINAC-SE-DGIRH-0624-2021, del 05 de agosto de 2021, suscrito por Hannia Rita Obando Razak, Asesora Legal del Departamento de Gestión Institucional de Recursos Humanos del Sistema Nacional de Áreas de Conservación. Lo anterior se dispone con el apercibimiento de que, de no acatar esta orden, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta Jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese.
